SummaryResumen

The Agrarian Tribunal rejected the objections alleging lack of subject-matter and territorial jurisdiction in summary proceedings seeking the removal of dangerous vegetation, brought by the owner of neighboring property. The complaint alleges that several trees and shrubs located on the defendant’s property encroach upon the applicant’s land and threaten the physical integrity of its premises. The Tribunal held that, regardless of the nature of the land where they grow, trees are natural resources forming part of national biodiversity. Consequently, under Article 108 of the Biodiversity Law, a dispute between private parties concerning those resources, where no administrative act or public-domain property is involved, falls within agrarian jurisdiction. It also determined that the Juzgado Agrario del Primer Circuito Judicial de Guanacaste has territorial jurisdiction over the canton of Cañas under Article 21 of the Agrarian Procedural Code and the territorial reallocation adopted by Corte Plena at session N° 30 – 2000. The case file was returned to that court for proceedings to continue.

V.- In this case, the applicant, in its capacity as owner, brings these proceedings alleging danger from one hundred canna shrubs, one large Guanacaste tree, one uruca tree, three lagartillo trees, and three guarumo trees that are purportedly on the defendant’s property and encroach upon its land, giving it a well-founded fear that the physical integrity of its property is at risk (see complaint at images 1 to 4 of the electronic case file). This Tribunal considers that, regardless of the nature of the property on which the tree sought to be removed because of the alleged danger is located, that forest element forms part of the natural resources and its adjudication therefore falls within this jurisdiction under Article 108 of the Biodiversity Law. As to territorial jurisdiction, pursuant to Article 21 of the Agrarian Procedural Code, the court of origin must continue the proceedings because the property is located in Cañas. Under the reallocation of territorial jurisdiction made by the Corte Plena agreement adopted at session N° 30 – 2000, held on 7 August 2000, the Juzgado Agrario del Primer Circuito Judicial de Guanacaste has jurisdiction because that agreement assigned it territorial jurisdiction over that canton. That court must therefore continue hearing these proceedings.- VI.

SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At fourteen hours and one minute on 6 August 2026.- SUMMARY DEMOLITION PROCEEDING (PROCESO SUMARIO DE DERRIBO) brought by AUTOTRANSPORTES ZAMI SOCIEDAD ANÓNIMA, legal-entity identification number three - one zero one – two hundred fourteen thousand eight hundred forty-nine, represented by Diego Zamora Rodríguez, of legal age, merchant, identity card number one – one thousand four hundred fifty-six – one hundred sixty-nine; against ADRIÁN GAMBOA HERNÁNDEZ, of legal age, pensioner, resident of Guanacaste, identity card number five – one hundred eleven – five hundred sixty-three. The PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Mauricio Castro Lizano, of legal age, married, resident of Heredia, identity card number one – seven hundred sixty-seven – three hundred two, is participating in the proceeding. Attorney Felipe Jaén Briceño acts as special judicial representative of the plaintiff company, and attorney Steve López Elizondo acts as counsel for the defendant. The proceeding is being heard in the Agrarian Court of First Instance (Juzgado Agrario) of the First Judicial Circuit of Guanacaste. This Court hears the appeal against the ruling issued at seven hours and thirty-three minutes on 15 May 2026.

Judge Picado Vargas writes the decision; and, REASONS:

I.The defendant raised objections for lack of subject-matter and territorial jurisdiction, asserting that the land at issue in this proceeding is land intended for construction and that, because of its location, jurisdiction lies with the Juzgado Civil de Cañas (image 64).-

II.By a ruling issued at seven hours and thirty-three minutes on 15 May 2026, the Juzgado Agrario del Primer Circuito Judicial de Guanacaste rejected the defendant’s objection for lack of territorial jurisdiction (image 74).-

III.The defendant disagrees with the ruling on the objection for lack of territorial jurisdiction, considering that jurisdiction lies with the Juzgado Civil de Cañas because this summary demolition proceeding is civil in nature (image 84).-

IV.The objections raised are unfounded. Regarding jurisdiction over summary demolition proceedings, this Court has held: “II. The interdicto de derribo, a proceeding seeking the demolition or removal of a dangerous building, structure, or tree, is available when the poor condition of a building, structure, or tree poses a threat to the rights of possessors or passersby, or may harm public property. It follows from the complaint that the alleged danger is associated with a 15-meter-tall almond tree that is said to pose a risk to passersby, a risk heightened during the rainy season. The specific harm is asserted by a person who states that they work in commercial premises located beside that tree. In this regard, the Court considers that this proceeding does fall within the jurisdiction of the Agrarian Jurisdiction because trees are natural resources forming part of national biodiversity. Trees, as natural resources, are governed, among other provisions, by the Ley de Biodiversidad, Article 11, subsection 3, of which provides that the environmental public interest is one of the criteria for applying that legislation.

Specifically, the provision states: ‘The use of the components of biodiversity must ensure development options for future generations, food security, ecosystem conservation, protection of human health, and improvement of citizens’ quality of life.’ Such matters must be considered in deciding this proceeding because a natural resource is involved, and subject-matter jurisdiction to make that determination is reserved by law to this Jurisdiction. Specifically, Article 108 of the Ley de Biodiversidad states: ‘In matters concerning biodiversity, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the administrative-litigation jurisdiction. As exceptions to the foregoing rule, offenses against biodiversity shall be tried by the criminal jurisdiction; likewise, disputes arising between private parties, where neither an administrative act nor public-domain property is involved, shall fall within the jurisdiction of the agrarian jurisdiction.’ It follows from the foregoing that, because this is a proceeding in which a private person asserts a claim concerning a natural resource, it falls within the subject-matter jurisdiction of the agrarian courts under the cited legislation; consequently, the declination of jurisdiction ordered by the lower court must be rejected.” (Voto N. 1577 -C-12 of 12:15 on 20 December 2012. See also, in this regard, Voto N. -50-C-13 of 08:51 on 08 January 2013).

V.In this case, the plaintiff, as owner, brought this proceeding alleging a danger involving one hundred caña india shrubs, one large Guanacaste tree, one uruca tree, three lagartillo trees, and three guarumo trees, which are allegedly located on the defendant’s property and encroach upon its property, giving rise to a well-founded fear that the physical integrity of its real property is at risk (see complaint at images 1 to 4 of the electronic case file). This Court considers that, irrespective of the nature of the property on which the tree whose removal is sought because of the alleged danger is located, because that forest element forms part of the natural resources, the processing of this matter falls within the jurisdiction of this Jurisdiction pursuant to Article 108 of the Ley de Biodiversidad. With respect to territorial jurisdiction, under Article 21 of the Código Procesal Agrario, the court of origin must continue the proceedings because the real property is located in Cañas and, pursuant to the redefinition of territorial jurisdiction made by the Full Court (Corte Plena) agreement adopted at session N° 30 – 2000, held on 7 August 2000, the Juzgado Agrario del Primer Circuito Judicial de Guanacaste has jurisdiction because that agreement granted it territorial jurisdiction over that Canton. Accordingly, that Court must continue hearing this proceeding.-

VI.In view of the foregoing, pursuant to Articles 11, subsection 3, and 108 of the Ley de Biodiversidad and Articles 1, 2, and 21 of the Código Procesal Agrario, the objections for lack of territorial and subject-matter jurisdiction must be rejected, and the case file must be remitted to the court of origin so that it may continue processing the proceeding.

THEREFORE:

The objections for lack of territorial and subject-matter jurisdiction are rejected, and the case file shall be remitted to the court of origin so that it may continue processing the proceeding.
