CONSIDERING
I.PROCEDURAL BACKGROUND.- The following matters are relevant:
Without prejudice to the literal wording of their submissions, all of which have been analyzed in full by this Chamber, each party argues, in summary, as follows: INDER.- The plaintiff entity’s legal representative states that, since 1963, there has been a conflict over precarious occupation of land on the Osa Peninsula belonging to the timber company Osa Productos Forestales, which led to confrontations and an atmosphere of great social tension. From 1978 onward, the Executive Branch, by Executive Decrees, brought land belonging to Osa Productos Forestales under protection as follows: a) Establishment of the boundaries of the Golfo Dulce Forest Reserve, hereinafter RFGD, by Article 1 of Executive Decree No. 8494-A (of 28 April 1978). b) First modification of the boundaries by Executive Decree No. 9388-A (of 30 November 1978). c) Second modification of the boundaries by Executive Decree No. 10142-A (of 12 June 1979).
It adds that in 1979, as a result of that conflict over precarious occupation, the Executive Branch of the Republic, by Executive Decrees Nos. 10088-G-H of 2 May and 10244G of 5 July, both from 1979, ordered the expropriation of the land held by Osa Productos Forestales, located on the Osa Peninsula, and its subsequent transfer to the Instituto de Tierras y Colonización (ITCO) and registration in the Public Property Registry, currently identified as title folio 39,334-000 of the Puntarenas province registry (hereinafter 6-039334-000). It states that the Institution established the Osa Peasant Settlement on the expropriated land. However, when it received that land, most of its area was already affected by the Golfo Dulce Forest Reserve (RFGD) and, as a result, incorporated into the State’s Natural or Forest Heritage. It explains that beginning in 1980, the Instituto de Desarrollo Agrario (IDA) began awarding and issuing titles to occupants of land in the Osa Peasant Settlement, an “activity that is denied” (sic) following Constitutional Chamber (Sala Constitucional) Vote No. 1763-94, issued at sixteen hours and forty-five minutes on 13 April 1994, which, although arising in connection with the Tivives Protected Zone, has broader application and must be applied by analogy to the RFGD, since both share the element of designation as a protected area, and because title to the land is held by the Instituto de Tierras y Colonización, a public-law entity.
It maintains that, in this regard, the Constitutional Chamber, in Vote 1763-94 of 16:45 on 13 April of that year, stated as follows: “Under Articles 32 and 34 of the Ley Forestal, the State’s forest heritage consists of all forests and forest lands in the national reserves, in areas declared inalienable, in properties registered in its name, and in properties belonging to municipalities, autonomous institutions, and other public administration agencies. For that reason, no public administration agency—centralized or decentralized—may expropriate, exchange, assign, or dispose of such land under any title, or deliver or lease it, unless it has first been classified by the General Forestry Directorate. If that Directorate considers the land suitable for forestry, it shall immediately become part of the State’s forest heritage.” It points out that, as a result, the part of the Osa Peasant Settlement affected by the RFGD must be considered State Natural Heritage (PNE) and, as such, classified as public domain property, with the attributes of inalienability and imprescriptibility.
It continues that, because ITCO owned the land transferred by the State, a gradual process of issuing titles began in favor of those already occupying the land, all under the concept of land colonization or agrarian reorganization, without subjecting those occupants to the socioeconomic procedures for selecting beneficiaries of land-allocation programs that are part of land-parceling processes. That process began with the support of the opinion of the Procuraduría General de la República No. C-143-83 of 11 May 1983. It states that in 1998, by resolution of the IDA Board of Directors, Article XL, Session 037-98, held on 6 May 1998, under the Ley de Titulación en Reservas Nacionales, it authorized the award, segregation and transfer of a parcel in settlement Osa Forestal, sector 7, to Cooperativa de Servicios Múltiples Cooperativos Coto 63 R.L., corporate identification number 3-004-194988, as beneficiaries and awardees of parcel P-218-1 in settlement Osa Forestal, sector 7, with an area of 10 ha 8629.58 m².
At the time that resolution was issued, parcel P-218-1 in settlement Osa Forestal, sector 7, already formed part of the PNE as of 1978, having automatically become part of it because it belonged to an autonomous institution and lay within the boundaries of the RFGD. It adds that, consequently, from its incorporation into the PNE, it became public domain property and, as such, inalienable and imprescriptible, so the Instituto de Desarrollo Agrario was legally barred from disposing of it (section 14 of the Ley Forestal), and therefore the resolution should be annulled. It asserts that certificate No. SINAC-ACOSA-PNE-017-2021, dated 4 May 2021, issued by the Osa Conservation Area, establishes that the parcel awarded to the defendant Cooperative, whose title history derives from property 6-39334-000, lies entirely within the protected wild area called RFGD and that all its areas form part of the PNE.
It maintains that under the applicable legal order, the RFGD must be considered PNE, classified as public domain property, with the attributes of imprescriptibility, inalienability and exemption from attachment, and must be administered by the Ministry of Environment and Energy (MINAE). Accordingly, the property in question, being affected by the RFGD, should be transferred to the State and administered by SINAC. It states that Executive Decree No. 8494-A of 28 April 1978, that is, the decree establishing the RFGD, provides (especially in Articles 4 and 5) for the PGR to register the land in the Public Property Registry as PNE and for SINAC to demarcate and monitor it. It states that by agreement adopted by the INDER Board of Directors in Article No. 35 of Ordinary Session 2, held on 24 January 2022, the declaration that the resolution of the Board of Directors of Instituto de Desarrollo Rural, Article XL, Session 037-98, held on 6 May 1998, was harmful to the public interest was considered, and the Legal Affairs Unit was instructed to bring these proceedings to declare the act harmful to the public interest before the Administrative Litigation Court, in order to annul it.
INTERESTED THIRD PARTIES—STATE AND SINAC.—Both public administrations support INDER’s case theory and maintain that, according to the overlay prepared by SINAC under letter SINAC-SE-IRT-085-2023 of 9 June 2023, the property identified as parcel P-218-1 of settlement Osa Forestal, sector 7, currently identified as cadastral plan 6-218657-1994, lies entirely within the boundaries of the Golfo Dulce Forest Reserve and has forest cover according to the forest inventory, since approximately 94% of the property is covered by forest. DEFENDANT COOPERATIVE.—The defendant cooperative entity’s special judicial attorney states that its client was awarded the land in good faith, relying on registry notice, Executive Decrees, and a law that appeared fully lawful and effective. The land at issue was awarded not only under decrees but also under Law 7599 of 29 April 1996, entitled “Ley de Titulación de Tierras ubicadas en Reservas Nacionales,” and, for present purposes, was upheld by Constitutional Chamber resolution 8560, issued at fifteen hours and thirty-seven minutes on 28 August 2001.
Although that resolution declared the law and the titles it generated unconstitutional, it limited the effects of that ruling to preserve titles acquired by third parties in good faith (such as its client’s title) if the State made no claim within three years. Along those lines, the State let the final period established in the resolution—understood as a period of lapse—expire without exercising its right to claim the property under that resolution. Once that period passed, it operated against the State and consolidated its client’s right under this title transferring ownership. It adds that any other right of the State to make a claim then “became time-barred” after more than ten years passed without action concerning a registered title that, as we have seen, it asserts, was consolidated in light of that Constitutional Chamber Vote. It concludes that, in light of the foregoing, the property in question is no longer inalienable, imprescriptible, or part of the public domain.
The following relevant facts are found: 1) Since 1963, a conflict over precarious occupation existed on the Osa Peninsula concerning land belonging to the timber company Osa Productos Forestales S.A., leading to continuous confrontations and a climate of social tension. (Undisputed fact); 2) The Executive Branch demarcated and modified the protected area of the Golfo Dulce Forest Reserve (RFGD) over Osa Productos Forestales’ land through the following legal instruments: a) Executive Decree No. 8494-A of 28 April 1978: Establishment of the initial boundaries of the Golfo Dulce Forest Reserve. b) Executive Decree No. 9388-A of 30 November 1978: First modification of the boundaries. c) Executive Decree No. 10142-A of 12 June 1979: Second modification of the boundaries. (Sistema Nacional de Legislación Vigente (National System of Current Legislation, SINALEVI));
None deemed necessary to decide this matter.
The Court will analyze the matter before it by addressing the subject in three sections or levels. The first addresses the requirements of proceedings to declare an administrative act harmful to the public interest, while the second examines whether those requirements are met in this case. Finally, the third section determines whether the challenged conduct conforms to the legal order. 1) Requirements of proceedings to declare an administrative act harmful to the public interest: In general terms, proceedings to declare an administrative act harmful to the public interest are a judicial mechanism through which the ordinary legislator authorized public administrations to seek annulment of acts they issued declaring subjective rights. In these judicial proceedings, the validity of a specific formal act is examined; as noted above, such an act creates subjective rights in favor of an individual or legal entity subject to the administration.
For that very reason, the participation of the recipient of the act whose annulment is sought is required, to ensure not only an opportunity to be heard but also the timely exercise of the right of defense. Article 34 of the Código Procesal Contencioso Administrativo is the provision establishing the preliminary elements and procedural rules for this mechanism. That provision must, however, be read together with sections 173.6 and 183 of the Ley General de la Administración Pública to provide a complete picture of the subject. From reading those provisions together, it follows that in these proceedings active standing belongs to the administration that issued the challenged act, while passive standing belongs to the person subject to the administration who is the recipient of the effects of that formal act. This is because, as stated above, these proceedings serve as a means of legally eliminating specific administrative acts that create subjective rights, where those acts are materially inconsistent with the legal order—that is, acts affected by absolute or relative nullity (Articles 128, 158, 165 and related provisions of the Ley General de la Administración Pública).
Thus, proceedings to declare an act harmful to the public interest provide an additional safeguard for the person subject to the administration: under the principle that an administration may not contradict its own acts, the administration cannot itself eliminate the effects of an act declaring subjective rights, but must do so through these proceedings and by a court independent of the administration that issued the act sought to be annulled as harmful to the public interest. It is also important to recall that the supreme hierarchical authority of the relevant public administration—the issuer of the formal act being challenged—must declare the act harmful to public, economic or other interests, supported by a technical-legal opinion. It is also important to recall that when the act originates from the Central Administration, only the Procuraduría General de la República may bring the claim (Article 16 of the CPCA).
As for the time available both to declare the act harmful and to bring these judicial proceedings, the current Código Procesal Contencioso Administrativo (CPCA) establishes a one-year period, calculated from the day after the act is issued, to declare it harmful in the administrative forum. This is subject to an exception where the formal act has defects of absolute nullity; under section 34.1 of the CPCA, the internal declaration may then be made for as long as the act’s effects continue. In that case, by mandate of that provision, the one-year period is calculated from the end of those effects, and the judgment ordering any eventual annulment will apply only to the annulment and future non-application of the challenged conduct. After the declaration that the act is harmful, the CPCA gives the relevant public administration one year—calculated from the day after that declaration becomes final—to bring proceedings for administrative litigation to declare the act harmful to the public interest (Article 39 of the CPCA).
In summary, based on the foregoing, bringing proceedings to declare an act harmful to the public interest and obtaining a ruling on the merits requires: i) A specific, final administrative act that declares subjective rights; ii) That the formal act have defects of absolute or relative nullity; iii) That the supreme hierarchical authority of the administration that issued the act declare, in the administrative forum, that the act is harmful to public, economic or other interests; iv) That the declaration that the act is harmful be made within the one-year period provided in section 34 of the CPCA—except as regards protection of public domain property, which is not subject to a time limit (section 34.2 of the CPCA); v) That the public administration that issued the act bring proceedings for administrative litigation to declare the act harmful to the public interest within the one-year period provided by Article 39.1.e of the CPCA—with the stated exception for public domain property. 2) Requirements for declaring the act harmful in this case.
Here, review of the case file shows that the declaration that the act is harmful meets the requirements set out above, as explained below. As established, the formal administrative act whose annulment is sought authorized the award, segregation and transfer of parcel P-218-1 in settlement Osa Forestal (sector 7), measuring 10 hectares and 8629,58 m², to Cooperativa de Servicios Múltiples Coto 63 R.L. Accordingly, INDER brings this action as the issuer of that formal act and directs it against the party holding a right derived from it. That is, the action concerns an administrative act declaring subjective rights that is considered harmful to the public interests the plaintiff entity must serve (requirement i). As regards procedural requirements, the internal declaration that the act was harmful was made by agreement adopted by the INDER Board of Directors under Article No. 35 of Ordinary Session No. 2, held on 24 January 2022, in accordance with Article 34 of the Código Procesal Contencioso Administrativo and section 173.2 of the Ley General de la Administración Pública, since that Board acts as the entity’s supreme hierarchical authority (requirement iii).
As for the timing—the periods within which the declaration that the act was harmful and the present proceedings were brought—because these proceedings concern the protection of public domain property, they are not subject to a time limit (section 34.2 of the CPCA). At this point, one requirement remains to be analyzed: whether the challenged administrative act conforms to the legal order, given the absolute-nullity defects alleged in this case (requirement ii). The Court considers it appropriate to undertake that analysis in a separate section. 3) Analysis of the validity of the challenged conduct. As INDER and the “Interested Third Parties” correctly point out, the Golfo Dulce Forest Reserve was established by Executive Decree 8494-A of 1 June 1978, and its area or extent was modified by Executive Decrees 9388-A of 30 November 1978 and 10142-A of 12 June 1979. Given its nature, the area is administered by the Ministry of Environment and Energy through the National System of Conservation Areas.
Here, Technical Certificate No. SINAC-ACOSA-PNE-017-2021, issued on 4 May 2021 by SINAC’s Osa Conservation Area, conclusively established that parcel P-218-1 (cadastral plan P-0218657-1994, derived from parent property No. 6-039334-000) lies entirely within the protected wild area of the Golfo Dulce Forest Reserve and wholly constitutes State Natural Heritage. The parcel currently corresponds to title folio 6-107474, plan P-218657-1994, and, as stated, comprises a portion of the property registered in INDER’s name under title folio 6-39334 within the Golfo Dulce Forest Reserve. Accordingly, as INDER and the Interested Third Parties argue, because the forests and forest lands or lands suitable for forestry in the Golfo Dulce Forest Reserve are public domain property as State Natural Heritage, the challenged administrative act authorizing the award, segregation and transfer of parcel P-218-1 to the defendant Cooperative is materially inconsistent with the legal order in light of Articles 13, 14 and 39(i) of Ley 7575, Article 38 of Law 7554, and Ley Forestal No. 4465, in force from 1969 to 1996.
The latter provided that possession of forests and forest lands belonging to autonomous institutions created no rights, a rule reiterated in section 14 of the current Ley Forestal, No. 7575 of 5 February 1996, which states: “Forest lands and forests that form part of the State’s Natural Heritage, as detailed in the preceding article, shall be exempt from attachment and inalienable; their possession by private parties shall create no rights in their favor, and the State’s action to recover these lands shall not be subject to limitation. Consequently, they may not be registered in the Public Registry through possessory information, and both invasion and occupation of them shall be penalized in accordance with this law.” Given their public domain status and ecological importance, such lands could not be exchanged, assigned, disposed of in any way, delivered, or leased (Ley 7575, Articles 13 to 15).
Accordingly, titling, segregation, parceling or disposal of land from property 6-39334 located in the Golfo Dulce Forest Reserve is not permitted. On the matter before us, the Constitutional Chamber stated:
“IV.- The specific case. The issuance of property titles for properties subject to the Golfo Dulce Forest Reserve. The applicant states that, despite having occupied for twenty-six years a parcel belonging to the Instituto de Desarrollo Agrario in Sierpe de Osa, that public institution has failed to issue titles to the properties, to his detriment and that of many other occupants, even though some deeds had previously been issued, making it inconsistent for the administration to continue delaying the issuance of titles. Based on the report submitted under oath and the evidence in the case file, the Chamber finds it established that the parcel occupied by the person seeking amparo lies within the so-called Osa Settlement, which is situated within properties that the State once expropriated from Osa Productos Forestales S.A. and that later became subject to a special protection regime when the Golfo Dulce Forest Reserve was established.
As the respondent authority states, the Instituto de Tierras y Colonización—later the Instituto de Desarrollo Agrario—began issuing titles to the properties gradually, but had to suspend that process because the land had been designated as part of the forest reserve, a designation with significant consequences. As a public institution, it is legally barred and unable to issue titles, since it must comply with the principle of legality and, in this case, clear provisions require that properties such as the one occupied by the applicant remain inalienable.
Under the cited case law, the Chamber finds that the administration is indeed absolutely barred from continuing the process of issuing titles to land within the Golfo Dulce Forest Reserve, unless a technically supported legal reform removing the protection designation were to occur in the future. Thus, the administration’s actions are neither arbitrary nor illegitimate, but are justified by a broad body of law—international, constitutional, statutory and executive decree provisions.
The Chamber has already had occasion to rule on a matter quite similar to this one, which also concerned the process of issuing titles to parcels from the same property registered under title folio number 39334-000 that the applicant claims. On that occasion, in judgment number 2007-8098, issued at sixteen hours and twenty-four minutes on 12 June 2007, the Chamber expressly held:
“The applicants ask this Court, in substance, to examine and determine whether land may be titled in the protected area of Golfo Dulce, as they believe they are entitled to such titles and that the respondents have refused to recognize that right. First, the applicants should be advised that, as appears from the initial petition itself and the Decrees cited therein, the designation of Golfo Dulce as a protected area or Forest Reserve, which covered eighty percent of the property in question, dates from April 1978, while the expropriation of that land from Osa Productos Forestales dates from May 1979. This means that the land they occupy was declared a Forest Reserve before it was distributed among the applicants, and therefore ITCO, followed by IDA, could not in fact issue titles to it.
“(…) In such circumstances, the respondents are materially unable to issue titles to land within forest reserves, as that course would be unconstitutional under this Court’s rulings, while safeguarding, as provided in the judgments cited, rights acquired in good faith in accordance with the scope the Chamber established in each judgment. Accordingly, the application is inadmissible, without prejudice to the applicants’ right to bring whatever actions they consider appropriate in the ordinary administrative-litigation forum to protect their interests and rights.” (Emphasis in the original. Judgment No. 2008008075, issued at 17:32 on 13 May 2008. The subject was also addressed in Votes Nos. 2988-1999, 8560-2001, 2063-2007, clarified by 4517-2007, 8098-2007 and 8075-2008, cited by INDER, PGR and SINAC.)
As the PGR correctly argues, that prohibition was also set out in section 8 of Law 5064 of 1972, which required the then ITCO, now INDER, to refrain from awarding land suitable for forestry. It is also set out in the 1998 Ley de Uso, Manejo y Conservación de Suelos, which bars the Institute from disposing to private parties of land that is not strictly suitable for agriculture or livestock (Articles 26, 27, 64). In these circumstances, this Chamber finds that the challenged act contains a serious defect in its ground, which results in absolute nullity of that act and the acts connected to that formal conduct. In this regard, it should be recalled that Article 133 of the Ley General de la Administración Pública provides:
“1. The ground must be legitimate and exist as it was taken into account in issuing the act.
“2. When it is not regulated, it must be proportionate to the content, and when it is regulated imprecisely, it must reasonably accord with the indefinite concepts used by the legal order.” Under the provision quoted, the ground is the why, justification or reasons the administration considered in issuing the act. As the legislator established, it must be legitimate (valid and consistent with the legal order) and exist as it was considered when issuing the act (that is, it must reflect the actual circumstances of the act adopted, without falsity). Here, as this judgment has shown, the ground for awarding, segregating and transferring the property to the defendant Cooperative is plainly illegitimate, resulting in an incurable defect of absolute nullity that extends to the element of content—Articles 132 and 166 of the LGAP—and consequently to the purpose. It is therefore appropriate to declare the act and all formal conduct connected to it null, as is hereby ordered. (On this subject, see judgments Nos. 2024005451, issued at 14:26 on 23 August 2024, and 2025001416, issued at 14:20 on 18 February 2025, both issued by the Administrative Litigation and Civil Treasury Court; and Votes Nos. 000881-F-S1-2025, issued at 09:26 on 29 May 2025, and 000521-F-S1-2026, issued at 09:40 on 16 April 2026, both issued by the First Chamber of the Supreme Court of Justice.)
VI- ON THE DEFENSES RAISED: As stated in item 2) of the “Procedural Background,” the defendant Cooperative’s representative answered the claim denying it and raised the preliminary defenses of limitation and lapse—both reserved by the Case-Management Judge for consideration in the judgment—as well as the defenses of lack of active standing and lack of right. As to the first two, it is sufficient to state that, since these proceedings concern a public domain property, neither of the two stated extinguishing doctrines applies here. As to active standing, since IDA, now INDER, issued the formal conduct whose annulment is sought as the basis for these proceedings, it clearly has standing to bring the action as it has done. As to lack of right, since the legal order supports the arguments and relief sought by the plaintiff public entity, that defense must be rejected, as is hereby ordered.
Under number 193 of the Administrative Litigation Procedure Code, procedural costs and personal costs are imposed on the losing party solely by virtue of having lost. This ruling must also be made on the court’s own motion, pursuant to that same provision, in conjunction with number 119.2 thereof. Exemption from this order is available only: a) when, in the Tribunal’s judgment, there was sufficient reason to litigate; b) when judgment is rendered on the basis of evidence unknown to the opposing party; or c) when there is a plus petitio, that is, when the difference between what was claimed and what was ultimately obtained is fifteen percent (15%) or more, unless the bases of the claim are expressly considered provisional or their determination depends on judicial discretion or an expert opinion (item 194 thereof). In this case, the Tribunal does not consider that any of those circumstances apply so as to displace the rule that the losing party must pay costs. Accordingly, the Tribunal finds that the appropriate course in this case is to order the defendant Cooperative to pay both categories of costs in this proceeding. The amount of those costs shall be determined in the judgment enforcement phase at INDER’s request.
THEREFORE
The defendant’s defenses of prescription, expiration, lack of standing, and lack of right are dismissed. Accordingly, the claim is granted, and therefore: i) Article XL, session 037-98, held on 6 May 1998 by the Board of Directors of the then Instituto de Desarrollo Agrario, is annulled solely with respect to the award of parcel P-218-1 in Asentamiento Osa, sector 7. ii) The land-registry entry for matrícula 107.474-000 in the Puntarenas registry district is annulled. iii) Survey plan No. P-0218657-1994 is annulled. iv) The defendant Cooperative is ordered to immediately deliver physical possession of parcel P-218-1 in Asentamiento Osa, sector 7, to the Ministerio de Ambiente y Energía through the Regional Office of Área Conservación Osa. v) The defendant Cooperative is ordered to pay both categories of costs in this proceeding. The amount of those costs shall be determined in the judgment enforcement phase at the request of the prevailing public entity. N° 2026005730 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las dieciocho horas con cinco minutos del diecinueve de agosto del dos mil veintiseis.- Proceso de Lesividad declarado de Puro Derecho, interpuesto por el INSTITUTO DE DESARROLLO RURAL, cédula jurídica 3-002-263243, representada por su apoderado especial judicial, Licenciado Pedro Esteban Cortés Delgado, carnet 25821 contra la COOPERATIVA DE SERVICIOS MÚLTIPLES COOPERATIVOS COTO 63 R.L., cédula jurídica 3-004-194988, representada por su apoderado especial judicial, Licenciado Luis Fernando Rojas Arredondo, carné 12394. Participan como “Terceros Interesados” el ESTADO, representado por la señora Procuradora Silvia Quesada Casares, carnet 13586 y el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN -SINAC-, representado por su apoderada especial judicial, Licenciada Gidgett Ramírez Hernández, carnet 17939.
CONSIDERANDO
I.ANTECEDENTES PROCESALES.- De relevancia, se tienen los siguientes:
Sin perjuicio de la literalidad de sus manifestaciones, las cuales han sido analizadas en su totalidad por esta Cámara, cada una de las partes aduce, en síntesis lo siguiente: INDER.- La representación legal de la entidad actora manifiesta, que desde 1963 existió en la zona de la Península de Osa, un conflicto de ocupación precaria en terrenos de la empresa maderera Osa Productos Forestales, lo que generó enfrentamientos y un clima de gran tensión social. Que, a partir de 1978, el Poder Ejecutivo mediante Decretos Ejecutivos, afectó terrenos de la Compañía Osa Productos Forestales. de la siguiente manera: a) Creación de los límites de la Reserva Forestal Golfo Dulce, en adelante RFGD, por el art 1 del Decreto Ejecutivo No. 8494-A (del 28 de abril de 1978). b) Primera Modificación de los límites por el Decreto Ejecutivo No. 9388-A (del 30 de noviembre de 1978). c) Segunda Modificación de los límites por el Decreto Ejecutivo No. 10142-A (del 12 de junio 1979).
Agrega, que en 1979, producto de aquel conflicto en precario, el Poder Ejecutivo de la República, mediante Decretos Ejecutivos números 10088-G-H del 2 de mayo y 10244G del 5 de julio, ambos del año 1979, dispuso la expropiación de los terrenos que mantenía la Empresa Osa Productos Forestales, localizados en la Península de Osa y su posterior traslado al Instituto de Tierras y Colonización (ITCO) e inscripción en el Registro Público de la Propiedad, identificado actualmente bajo el número de folio real matrícula del Partido de Puntarenas, treinta y nueve mil trescientos treinta y cuatro-cero cero cero (en adelante 6-039334-000). Indica, que la Institución sobre los terrenos expropiados, constituyó el Asentamiento Campesino Osa. No obstante, cuando recibió esos terrenos, la mayor parte de su extensión ya se encontraba afectada por la Reserva Forestal Golfo Dulce (RFGD) y como resultado incorporados al Patrimonio Natural o Forestal del Estado.
Explica, que a partir de 1980, el Instituto de Desarrollo Agrario (IDA) inició una etapa de adjudicación y titulación a los ocupantes de los terrenos en el Asentamiento Campesino Osa, “actividad que se niega” (sic) con ocasión del Voto de la Sala Constitucional número 1763-94 de las dieciséis horas con cuarenta y cinco minutos del trece de abril de mil novecientos noventa y cuatro, que si bien surge con relación a la Zona Protectora Tivives, sus alcances trascienden y deben ser aplicados por analogía en la RFGD, en el tanto tiene como elemento común la afectación como área protegida, aunado a que la titularidad del terreno la ostenta el Instituto de Tierras y Colonización, entidad de derecho público. Sostiene, que al respecto, la Sala Constitucional en su Voto 1763-94 de las 16 horas con 45 minutos del 13 de abril de ese año, indicó lo siguiente: “De acuerdo con los artículos 32 y 34 de la Ley Forestal, el patrimonio forestal del Estado está constituido por todos los bosques y terrenos forestales de las reservas nacionales de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a las municipalidades, a las instituciones autónomas y a los demás organismos de la Administración Pública, por esa razón, ningún organismo de la Administración Pública -central o descentralizada- podrá expropiar-, permutar, ceder o enajenar a cualquier título, entregar o dar en arrendamiento, terrenos rurales de su propiedad o bajo su administración, sin que previamente hayan sido clasificados por la Dirección General Forestal, en cuyo caso si ésta los considerara de aptitud forestal quedarán inmediatamente incorporados al patrimonio forestal del Estado.” Señala, que resultado de lo anterior, el área del Asentamiento Campesino Osa afectado por la RFGD debe ser considerada como PNE, y como tal, calificado como un bien de dominio público, con las prerrogativas de inalienabilidad e imprescriptibilidad.
Continúa manifestando, que siendo propietario el ITCO de las tierras cedidas por el Estado, se inició un proceso paulatino de titulación de tierras a favor de quienes se encontraban de antemano ocupando los terrenos, todo lo anterior bajo el concepto de colonización de tierras o reordenamiento agrario, sin sujeción de los ocupantes de estas tierras a los procedimientos socioeconómicos de selección de beneficiarios de los programas de dotación de tierras, propios de los procesos de parcelación de tierras, proceso que se inicia con respaldo del pronunciamiento de la Procuraduría General de la República número C-143-83 del 11 de mayo de 1983. Expone, que en 1998, mediante Acuerdo de Junta Directiva del IDA (hoy Inder), Artículo XL, sesión 037-98, celebrada el 6 de mayo de 1998, al amparo a la Ley de Titulación en Reservas Nacionales, se autorizó a adjudicar, segregar y traspasar, una parcela del asentamiento Osa Forestal sector 7 a la Cooperativa de Servicios Múltiples Cooperativos Coto 63 R.L., cédula jurídica número 3-004-194988, como beneficiarios y adjudicatarios de la parcela P-218-1 asentamiento Osa Forestal, sector 7, con un área de 10 ha 8629.58 m2.
Que en el momento en que se generó el acuerdo citado, el inmueble P-218-1 asentamiento Osa Forestal, sector 7, ya formaba parte del PNE desde 1978, habiendo ingresado a este automáticamente al pertenecer a una institución autónoma y estar comprendido dentro de los límites de la RFGD. Añade, que en consecuencia, desde su incorporación al PNE, se conviene en un bien de dominio público, y en esa medida, deviene en inalienable e imprescriptible, por lo que el Instituto de Desarrollo Agrario estaba impedido legalmente para enajenarlo (numeral 14 de la Ley Forestal), y ante esa medida, procede la anulación del citado acuerdo. Afirma, que mediante certificación No. SINAC-ACOSA-PNE-017-2021, de fecha 4 de mayo de 2021, del Área de Conservación Osa, se demuestra que el predio adjudicado a la Cooperativa accionada, que mantiene sus antecedentes de dominio de la finca 6-39334-000, se encuentra en un cien por ciento de su cabida dentro del Área Silvestre Protegida llamada RFGD y que todas sus áreas conforman PNE.
Sostiene, que de conformidad con el ordenamiento jurídico vigente, la RFGD debe ser considerada como PNE, el cual es calificado como un bien de dominio público, con las prerrogativas de imprescriptibilidad, inalienabilidad e inembargabilidad, que debe ser administrado por el Ministerio del Ambiente y Energía (MINAE). Que de esa manera, lo procedente es que la propiedad dicha, al encontrarse afectada por la RFGD deberá ser traspasada al Estado y administrada por el SINAC. Expone, que es el mismo Decreto Ejecutivo No. 8494-A del 28 de abril de 1978, es decir, desde la creación de la RFGD, el que establece (especialmente el artículo 4 y 5) la obligación en la PGR de inscribir los terrenos en el Registro Público de la Propiedad como PNE y la obligación del SINAC de deslindar y vigilar estos terrenos. Manifiesta, que mediante acuerdo tomado por la Junta Directiva del INDER, en el artículo No. 35 de la Sesión Ordinaria 2, celebrada el 24 de enero de 2022, se conoció la declaratoria de Lesividad del acuerdo de Junta Directiva del Instituto de Desarrollo Rural, artículo XL, Sesión 037-98, celebrada el 6 de mayo de 1998, y se instruyó a la Unidad de Asuntos Jurídicos para que ¡nterpusiera el presente proceso de Lesividad ante el Tribunal Contencioso Administrativo, con el fin de anular el mismo.
TERCEROS INTERESADOS -ESTADO-SINAC-. Ambas Administraciones Públicas apoyan la Teoría del Caso del INDER y en ese tanto, sostienen que según montaje efectuado por el SINAC mediante oficio SINAC-SE-IRT-085-2023 del 09 de junio del 2023, consta que el inmueble identificado como predio P-218-1 del Asentamiento Osa Forestal, Sector 7, actualmente identificado como plano catastrado 6-218657-1994, se encuentra inmerso en un 100% dentro de los límites de la Reserva Forestal Golfo Dulce, además de presentar condición boscosa según el inventario forestal, pues aproximadamente el 94% de la propiedad se encuentra con bosque. COOPERATIVA DEMANDADA. El apoderado especial judicial de la entidad cooperativa demandada, manifiesta que su representada fue adjudicada actuando de buena fe, al amparo de la publicidad registral, Decretos Ejecutivos y una ley con apariencia de total legalidad y eficacia. Que la adjudicación de la tierra objeto de la presente litis, se dio solo al amparo de decretos sino al amparo de la ley 7599 del 29 de abril de 1996, denominada "Ley de Titulación de Tierras ubicadas en Reservas Nacionales", y está ratificada para los efectos que nos interesa, por medio de la resolución de Sala Constitucional 8560 de las quince horas con treinta y siete minutos del 28 de agosto de 2001, la cual no obstante declaró inconstitucional esta ley y los títulos que generó, dimensionó sus efectos en el sentido de preservar los títulos adquiridos por terceros de buena fe (como el de su representada), si transcurridos tres años el Estado no reclamaba nada.
Que en esa línea, el Estado dejó transcurrir el plazo fatal dado en la resolución, mismo que debe entenderse como plazo de caducidad, sin ejercer el derecho de reclamar el bien al amparo de esa resolución, y pasado el plazo se volvió en su contra y consolidó el derecho de su representada sobre este título traslativo de dominio. Añade, que entonces “prescribió” cualquier otro derecho del Estado a reclamar, por haber transcurrido más de diez años sin actuar sobre un título registral que como vimos -afirma-, se consolidó a la luz del citado Voto de la Sala Constitucional. Concluye señalando, que con ocasión de lo expuesto, el referido inmueble ha dejado de ser inalienable, imprescriptible y demanial.
Se tienen como hechos probados de relevancia, los siguientes: 1) Que desde el año 1963 existió en la zona de la Península de Osa un conflicto de ocupación precaria sobre terrenos que pertenecían a la empresa maderera Osa Productos Forestales S.A., situación que derivó en continuos enfrentamientos y un escenario de tensión social. (Hecho no controvertido); 2) Que el Poder Ejecutivo delimitó y modificó el área protegida de la Reserva Forestal Golfo Dulce (RFGD) sobre los terrenos de Osa Productos Forestales mediante los siguientes instrumentos jurídicos: a) Decreto Ejecutivo No. 8494-A del 28 de abril de 1978: Creación de los límites iniciales de la Reserva Forestal Golfo Dulce. b) Decreto Ejecutivo No. 9388-A del 30 noviembre de 1978: Primera modificación de límites. c) Decreto Ejecutivo No. 10142-A del 12 de junio de 1979: Segunda modificación de límites. (Sistema Nacional de Legislación Vigente -SINALEVI-);
Ninguno estimado necesario para fallar el presente asunto.
Se procederá al análisis del asunto sometido a conocimiento de esta Cámara, abordando la temática objeto del mismo en tres acápites o niveles. En el primero de ellos, se tratará el tema de los presupuestos propios de un Proceso de Lesividad, mientras que en el segundo, se examinará si los mismos se encuentran presentes en el caso concreto. Por último, en el tercero de los apartados, se procederá a determinar si las conductas impugnadas son conformes o no con el ordenamiento jurídico. 1) Presupuestos del Proceso de Lesividad: En términos generales, el Proceso de Lesividad es un mecanismo jurisdiccional, por medio del cual el legislador ordinario autorizó a las Administraciones Públicas, a deducir pretensiones anulatorias respecto de actos declaratorios de derechos subjetivos dictados por ellas. En estos tipos de procesos judiciales, se analiza la validez de una conducta formal concreta, que tal y como se indicó líneas atrás, genera derechos subjetivos a favor de un administrado -persona física o jurídica-.
Precisamente por ello, se hace necesaria la obligada participación del destinatario del acto cuya nulidad se pretende, a efectos de garantizar no solamente el contradictorio, sino el ejercicio oportuno de su derecho de defensa. El artículo 34 del Código Procesal Contencioso Administrativo, es la norma que fija los elementos previos y regulaciones procesales de esta figura. Sin embargo, dicho precepto normativo debe concordarse con los numerales 173.6 y 183, ambos de la Ley General de la Administración Pública a efecto de tener un panorama completo sobre la temática que se aborda. Precisamente de la referida concordancia, se concluye que en este tipo de Procesos la legitimación activa se concede a la Administración emisora del acto atacado, en tanto que el legitimado pasivo es el administrado destinatario de los efectos de esa conducta formal. Ello es así, por cuanto como se indicó líneas atrás, la lesividad se constituye en un instrumento de supresión jurídica de actos administrativos concretos creadores de derechos subjetivos, en el tanto los mismos sean sustancialmente disconformes con el ordenamiento jurídico -actos viciados de nulidad absoluta o relativa- (artículos 128, 158, 165 y concordantes de la Ley General de la Administración Pública).
Así entonces, el proceso de lesividad, es una garantía más para el administrado, en el que en aplicación del principio de intangibilidad de los actos propios, la Administración no puede por sí misma eliminar los efectos de una acto declaratorio de derechos subjetivos, sino es a través de este proceso y por parte de un Tribunal, independiente de la Administración autora del acto que se pide anular por lesivo al interés público. Ahora bien, es importante recordar que además de lo ya señalado, resulta esencial que el superior jerárquico supremo de la Administración Pública respectiva -emisora de la conducta formal que se ataca- declare la lesividad del acto, por lesionar el mismo intereses públicos, económicos o de cualquier otra naturaleza, para lo cual, requiere contar con un criterio técnico-jurídico que sustente esa decisión. Igualmente es importante recordar, que cuando el acto emane de la Administración Central, la demanda solo podrá ser incoada por la Procuraduría General de la República (artículo 16 del CPCA).
En lo que respecta al tiempo con que se cuenta, tanto para declarar lesivo el acto como para interponer el proceso judicial de comentario, el actual Código Procesal Contencioso Administrativo -CPCA-, establece el plazo de un año computado a partir del día siguiente al de la emisión del acto, para declararlo lesivo en sede administrativa. Lo anterior, salvo los supuestos en que la referida conducta formal tenga vicios de nulidad absoluta, en cuyo caso, al tenor de lo regulado por el ordinal 34.1 del CPCA, esa declaratoria interna puede hacerse mientras perduren los efectos del acto. En tal caso, por mandato de dicha norma, el año se computa desde el cese de sus efectos y la sentencia que disponga la eventual nulidad, lo hará únicamente para la anulación e inaplicabilidad futura de la conducta impugnada. Luego de la declaratoria de lesividad, el CPCA otorga el plazo de un año a la Administración Pública respectiva -computado a partir del día siguiente a la firmeza de tal declaratoria- para incoar el Proceso Contencioso Administrativo de Lesividad -artículo 39 del CPCA-.
En síntesis, conforme lo hasta aquí señalado, para la instauración de un Proceso de Lesividad y consecuente pronunciamiento sobre el fondo del asunto, se requiere: i) La existencia de un acto administrativo concreto, firme y declaratorio de derechos subjetivos; ii) Que dicha conducta formal, tenga vicios de nulidad absoluta o relativa; iii) Que el referido acto haya sido declarado lesivo a los intereses públicos, económicos o de cualquier otra naturaleza en sede administrativa, por el Superior Jerárquico Supremo de la Administración emisora del mismo; iv) Que tal declaratoria de lesividad se realice dentro del plazo del año previsto en el numeral 34 del CPCA -salvo en lo relativo a la tutela de bienes de dominio público que no está sujeto a plazo -artículo 34.2 del CPCA; v) Que el Proceso Contencioso de Lesividad se incoe por la Administración Pública emisora del acto, en el plazo del año previsto por el artículo 39.1.e del CPCA -con la con la salvedad dicha en cuanto a los bienes de dominio público-. 2) Presupuestos de lesividad en el caso concreto.
En la especie, del análisis de los autos se concluye, que la declaratoria de lesividad cumple con los presupuestos señalados en el apartado anterior, lo cual se explica seguidamente. Según se ha establecido, la conducta administrativa formal, cuya anulación se pretende, autorizó la adjudicación, segregación y traspaso de la parcela identificada como P-218-1 del Asentamiento Osa Forestal (sector 7), con una cabida de 10 hectáreas y 8629,58 m², a favor de la Cooperativa de Servicios Múltiples Coto 63 R.L. De ahí que el INDER, formula esta acción como autor de la conducta formal dicha y la dirige contra quien ostenta un derecho derivado de la misma. Es decir, la acción recae sobre un acto administrativo declaratorio de derechos subjetivos, que se estima lesivo a los intereses públicos que debe satisfacer el ente accionante (presupuesto i). En lo atinente a las exigencias procedimentales, la declaratoria interna de lesividad fue realizada mediante acuerdo adoptado por la Junta Directiva del INDER, en el Artículo No. 35 de la Sesión Ordinaria No. 2 celebrada el 24 de enero de 2022, de conformidad con el artículo 34 del Código Procesal Contencioso Administrativo y 173.2 de la Ley General de la Administración Pública, toda vez que la misma actúa como superior jerárquica suprema, de dicha entidad pública.
(presupuesto iii). En lo que atañe a los momentos -plazos- en los cuales se produjeron tanto la declaratoria de lesividad como la interposición del presente proceso, en tanto nos encontramos frente a un Proceso de Lesividad vinculado con la tutela de bienes de dominio público, no está sujeto a plazo -artículo 34.2 del CPCA-. Llegado a este punto, se evidencia que resta un presupuesto por analizar, referido precisamente a la conformidad o no -por vicios de nulidad absoluta en este caso- del acto administrativo impugnado con el ordenamiento jurídico (presupuesto ii). Para ello, el Tribunal ha considerado pertinente realizar tal análisis en un apartado exclusivo. 3) Análisis sobre la validez de las conductas cuestionadas. Como bien lo señalan tanto el INDER como los “Terceros Interesados” la Reserva Forestal Golfo Dulce fue creada mediante Decreto Ejecutivo 8494-A del 1 de junio de 1978 y su cabida, área o extensión se modificó mediante los Decretos Ejecutivos 9388-A del 30 de noviembre de 1978 y 10142-A del 12 de junio de 1979.
La referida área, en razón de su naturaleza, es administrada por el Ministerio de Ambiente y Energía a través del Sistema Nacional de Áreas de Conservación. Ahora bien, en la especie, mediante la Certificación Técnica No. SINAC-ACOSA-PNE-017-2021 emitida el 4 de mayo de 2021 por el Área de Conservación Osa del SINAC, se acreditó de forma fehaciente que el predio P-218-1 (plano catastrado P-0218657-1994, derivado de la finca matriz No. 6-039334-000) se ubica en un 100% de su cabida dentro del Área Silvestre Protegida Reserva Forestal Golfo Dulce, constituyendo en su totalidad Patrimonio Natural del Estado. Dicho predio se corresponde actualmente con la matrícula 6-107474, plano P-218657-1994 y como se ha dicho, comprende una porción de la finca inscrita a nombre del INDER, matrícula 6-39334 dentro de la Reserva Forestal Golfo Dulce. Así las cosas, como bien lo aduce el INDER y los Terceros Interesados, siendo que los bosques y terrenos forestales o de aptitud forestal de la Reserva Forestal Golfo Dulce, son de dominio público en calidad de Patrimonio Natural del Estado, el acto administrativo que se cuestiona y mediante el cual se autorizó la adjudicación, segregación y traspaso del predio P-218-1 a favor de la Cooperativa accionada, resulta sustancialmente disconforme con el ordenamiento jurídico, a la luz de los Artículos 13, 14 y 39 inciso i) de la Ley 7575, 38 de la Ley 7554, así como la Ley Forestal No. 4465 vigente entre 1969 y 1996, en tanto estableció que la posesión en bosques y terrenos forestales de las fincas pertenecientes a instituciones autónomas no generaba derechos, lo que fue reiterado en el numeral 14 de la Ley Forestal actual, No. 7575 de 5 de febrero de 1996, al disponer dicha norma, que “los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible.
En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley.” Debido a la condición demanial dicha y su importancia ecológica, tales terrenos no podían ser permutados, cedidos, enajenados de ninguna manera, entregados, ni dados en arrendamiento (Ley 7575, artículos 13 a 15). Por ello, no procede la titulación, segregación, parcelación o enajenación de terrenos de la finca 6-39334 ubicados en la Reserva Forestal Golfo Dulce. Precisamente sobre el tema que nos ocupa, la Sala Constitucional señaló:
“IV.- El caso concreto. El otorgamiento de títulos de propiedad en inmuebles sometidos a la Reserva Forestal Golfo Dulce. Refiere el recurrente que manteniendo una ocupación de veintiséis años sobre una parcela del Instituto de Desarrollo Agrario en Sierpe de Osa, tal institución pública omite la titulación de las propiedades en perjuicio suyo y de una gran cantidad de ocupantes, siendo que ya se habían otorgado con anterioridad algunas escrituras, por lo que resulta inconsecuente que la administración continúe atrasando la titulación. Del informe rendido bajo la gravedad del juramento y de la prueba que consta en autos, la Sala tiene por acreditado que la parcela que ocupa el amparado se encuentra dentro del denominado Asentamiento Osa, el cual se enclava dentro de las propiedades que en su momento el Estado expropió a la compañía Osa Productos Forestales S.A., y que quedó luego afectada bajo un régimen especial de protección al constituirse la Reserva Forestal Golfo Dulce.
Tal como lo señala la autoridad recurrida, el Instituto de Tierras y Colonización –luego Instituto de Desarrollo Agrario- inició en su oportunidad la titulación de los inmuebles de manera paulatina, pero que por la trascendencia de la afectación de los terrenos como pertenecientes a la citada reserva forestal, hubo de suspender la titulación pues legalmente se encuentra impedido e imposibilitado de hacerlo, pues como institución pública debe apegarse al principio de legalidad y, en el presente caso, existen claras disposiciones que ordenan la inalienabilidad de los inmuebles como el ocupado por el recurrente.
De conformidad con la jurisprudencia de cita, la Sala advierte que en efecto la administración se encuentra absolutamente impedida de continuar con el proceso de titulación de los terrenos que quedaron inmersos dentro de la Reserva Forestal Golfo Dulce - salvo que en el futuro sobreviniera una reforma legal técnicamente fundamentada que eliminara la afectación-, por lo que no se está en presencia de un acto arbitrario o ilegítimo de la administración, sino de actuaciones amparadas de manera justificada en un amplio espectro normativo –internacional, constitucional, legal y vía decreto ejecutivo-.
La Sala ha tenido ya oportunidad de pronunciarse en un asunto bastante similar al presente, donde también se discutió el proceso de titulación de las parcelas de la misma finca inscrita bajo el sistema de folio real número 39334-000 que reclama el amparado; en esa oportunidad, y mediante sentencia número 2007-8098, de las dieciséis horas veinticuatro minutos del doce de junio de dos mil siete, definió expresamente la Sala:
“Los recurrentes pretenden que este Tribunal, en el fondo, analice y determine la procedencia de un proceso de titulación de tierras en la zona protegida de Golfo Dulce, pues estiman que les asiste ese derecho y que los recurridos no se los ha querido reconocer. En primer término cabe indicarle a los petentes que, según se desprende del propio memorial inicial y de los Decretos en él citados, la declaratoria de zona protegida o Reserva Forestal de Golfo Dulce, en la cual se vio inmerso un ochenta por ciento del inmueble en cuestión data de abril mil novecientos setenta y ocho y la expropiación de esas tierras a Osa Productos Forestales de mayo de mil novecientos setenta y nueve. Eso quiere decir que las tierras que habitan fueron declaradas Reserva Forestal antes de ser repartidas entre los recurrentes, por lo que de hecho no podía el ITCO y luego el IDA titular sobre las mismas.
(…) En tales supuestos, existe una imposibilidad material para los recurridos de titular terrenos dentro de las reservas de carácter forestal por resultar tal proceder inconstitucional, según lo dispuesto por este Tribunal, salvaguardándose, conforme al contenido de las sentencias transcritas, los derechos adquiridos de buena fe según el dimensionamiento que esta Sala estableció en cada una de las sentencias citadas. Por ello el recurso planteado resulta improcedente, y así debe declararse, sin perjuicio de que los recurrentes puedan iniciar en contra de los recurridos las acciones que estimen pertinentes en la vía ordinaria contencioso administrativa, tendente a la protección de sus intereses y derechos.” (La negrita corresponde al original. Sentencia No. 2008008075 de las 17:32 horas del 13 de mayo de 2008. Tema igualmente abordado en los Votos Nos. 2988-1999, 8560-2001, 2063-2007 aclarado por el 4517-2007, 8098-2007 y 8075-2008, referenciados por el INDER, PGR y SINAC).
Esa prohibición, como bien lo aduce la PGR, estuvo también en el numeral 8 de la Ley 5064 de 1972, que disponía que el entonces ITCO, hoy INDER, debía abstenerse de adjudicar tierras de vocación forestal. Y, lo está en la Ley de Uso, Manejo y Conservación de Suelos de 1998, que impide al Instituto disponer, a favor de particulares, terrenos que no sean de estricta vocación agropecuaria (artículos 26, 27, 64). Encontrándose así las cosas, es criterio de esta Cámara que el acto impugnado contiene un vicio grave en el elemento motivo, que genera la nulidad absoluta tanto del mismo como de los conexos con dicha conducta formal. En esta línea, ha de recordarse que el artículo 133 de la Ley General de la Administración Pública, establece que:
"1. El motivo deberá ser legítimo y existir tal y como ha sido tomado en cuenta para dictar el acto.
2. Cuando no esté regulado deberá ser proporcionado al contenido y cuando esté regulado en forma imprecisa deberá ser razonablemente conforme con los conceptos indeterminados empleados por el ordenamiento." Conforme a la norma transcrita, puede decirse que el motivo es el por qué, la justificación o las razones que tomó en cuenta la Administración para dictar el acto. El mismo, según lo estableció el legislador, debe ser legítimo (válido y conforme al ordenamiento jurídico) y existir tal y como ha sido tomado en cuenta para dictar el acto (obedecer a la realidad del acto que se adopta, sin falsedad). En la especie, siendo que a lo largo del presente Fallo se ha evidenciado que el motivo para la adjudicación, segregación y traspaso del inmueble propiedad de la Cooperativa accionada, resulta evidentemente ilegítimo, se genera un vicio insalvable de nulidad absoluta, que irradia al elemento contenido -artículos 132 y 166 de la LGAP- y consecuentemente al fin.
Por lo que, resulta procedente declarar la nulidad del mismo y toda actuación formal conexa con dicha conducta, como en efecto se dispone. (Sobre el tema, pueden consultarse las sentencias Nos. 2024005451 de las 14:26 horas del 23 de Agosto de 2024 y 2025001416 de las 14:20 horas del 18 de Febrero de 2025, ambas emitidas por el Tribunal Contencioso Administrativo y Civil de Hacienda. Así como los Votos Nos. 000881-F-S1-2025 de las 09:26 horas del 29 de mayo de 2025 y 000521-F-S1-2026 de las 09:40 horas del 16 de abril de 2026, ambos dictados por la Sala Primera de la Corte Suprema de Justicia).
VI- DE LAS EXCEPCIONES OPUESTAS: Tal y como fue indicado en el punto 2) de los “Antecedentes Procesales”, la representación de la Cooperativa accionada, contestó negativamente la demanda y opuso las defensas previas de prescripción y caducidad -ambas reservadas por el Juzgador de Trámite a efecto de que fueran conocidas en sentencia-, así como las excepciones de falta de legitimación activa y falta de derecho. Respecto de las dos primeras, baste señalar que en tanto estamos frente a un Proceso de Lesividad relacionado con un bien demanial, ninguna de las 2 figuras extintivas que se indican puede operar en la especie. En lo atinente a la legitimación activa, siendo el IDA, hoy INDER, el autor de la conducta formal cuya nulidad se pretende como base del presente Proceso de Lesividad, claro está que la misma se encuentra legitimada para accionar en la forma que lo viene haciendo. Respecto de la falta de derecho, siendo que el ordenamiento jurídico ampara lo argumentado y pedido por la entidad pública accionante, la excepción dicha debe rechazarse como en efecto se dispone.
De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales son impuestas al vencido por el solo hecho de serlo, pronunciamiento que debe hacerse incluso de oficio, al tenor de lo dispuesto en esa misma norma, en concordancia con el numeral 119.2 ibídem. La dispensa de esta condena sólo es viable: a) cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar; b) cuando la sentencia se dicte en virtud de pruebas que desconociera la parte contraria; o bien, c) cuando se incurra en plus petitio, esto es, cuando la diferencia entre lo reclamado y lo obtenido en definitiva sea de un quince por ciento (15%) o más, a no ser que las bases de la demanda sean expresamente consideradas provisionales o su determinación dependa del arbitrio judicial o dictamen de peritos (ordinal 194 ibídem). En la especie, no aprecia este Tribunal que estemos frente alguno de los presupuestos dichos, que permitan quebrar el postulado de condenatoria en costas al vencido. Siendo ello así, se estima que en la especie, lo procedente es condenar a la Cooperativa demandada al pago de ambas costas del presente Proceso. Quantum de las mismas que se determinará en la Fase de Ejecución de sentencia a instancia del INDER.
POR TANTO
Se rechazan las excepciones de prescripción, caducidad, falta de legitimación y falta de derecho opuestas por la demandada. En razón de ello, se declara con lugar la demanda y en consecuencia: i) Se anula el artículo XL, sesión 037-98, celebrada el 6 de mayo de 1998 de la Junta Directiva del entonces Instituto de Desarrollo Agrario, únicamente en lo que respecta a la adjudicación del predio P-218-1 del Asentamiento Osa, sector 7. ii) Se anula el asiento registral matrícula del partido de Puntarenas 107.474-000. iii) Se anula el plano No. P-0218657-1994. iv) Se ordena a la Cooperativa demandada a la inmediata entrega material y puesta en posesión del predio P-218-1 del Asentamiento Osa, sector 7, al Ministerio de Ambiente y Energía por medio de la Oficina Regional del Área Conservación Osa. v) Se condena a la Cooperativa accionada, al pago de ambas costas del presente Proceso. Quantum de las mismas que se determinará en la Fase de Ejecución de sentencia, a instancia de la entidad pública vencedora.
