Criminal case 22-000272-0359-PE brought against [Nombre 001], of legal age, Costa Rican, identity card [Valor 001], and [Nombre 002], of legal age, Costa Rican, identity card [Valor 002], for the offense of INVASION OF A CONSERVATION OR PROTECTION AREA, to the detriment of NATURAL RESOURCES. The matter is decided as follows:
Drafted by Sentencing Appeals Judge Marco Mairena Navarro; and, REASONS:
I.The accused [Nombre 001] and [Nombre 002] file an “appeal against judgment” challenging decision number 19-2026, issued by the Trial Court of Cartago, Turrialba seat, at 11:04 a.m. on 25 June 2026, which declared inadmissible the challenge filed by Attorney Oscar Enrique Pessoa Arias, counsel for the accused, against the ruling issued at 9:30 a.m. on 7 May of this year by the Criminal Court of Turrialba. In that ruling, applying section 140 of the Code of Criminal Procedure, the court ordered as follows: “ [Nombre 001], identity card [Valor 003], and [Nombre 002], identity card [Valor 004], are ordered to proceed to demolish the buildings located within the protection area of the stream, and also to plant trees at the site, all within two months from personal service of the ruling resolving this request, UNDER PENALTY OF INCURRING THE OFFENSE OF DISOBEDIENCE OF AUTHORITY AND OF THE IMPOSITION OF MORE SEVERE PRECAUTIONARY MEASURES AGAINST HER.- This ruling shall be served on the victim of known address who has requested to be informed about the criminal proceedings, as well as on the other parties who have appeared in the proceedings.” [sic].
II.The appeal is inadmissible. In analyzing the admissibility of the appeal brought before this Court, it must be stated that Law number 8837 of 3 May 2010, in force since 9 December 2011, introduced the appeal against judgment and thereby established the current coexistence in our criminal procedure system of two different types of appeal: 1. An appeal against interlocutory rulings issued by judges at the preparatory and intermediate stages, pursuant to section 453 of the Code of Criminal Procedure, which is heard by criminal courts sitting with a single judge (Article 96 bis of the Organic Law of the Judiciary). 2. An appeal against judgments and dismissals issued at the trial stage, resolving criminal, civil, incidental, and other matters specified by law, pursuant to Article 458 of the Code of Criminal Procedure. This appeal is heard by the Criminal Sentencing Appeals Court (Article 93 of the Organic Law of the Judiciary).
It follows that not every ruling issued by a trial court may be appealed to this Court; only judgments and dismissals issued at the trial stage may be appealed. In this case, the challenged ruling does not have that character. In decision number 19-2026, the Trial Court of Cartago, Turrialba seat, declared inadmissible an appeal filed by the defense against a ruling of the Criminal Court. Consequently, under the principle of objective appealability, that order is not subject to appeal by this route.
THEREFORE:
The appeal against judgment filed by the accused [Nombre 001] and [Nombre 002] is declared inadmissible. Notify the parties.

Causa penal 22-000272-0359-PE seguida contra [Nombre 001] mayor, costarricense, cédula [Valor 001] y [Nombre 002] mayor, costarricense, cédula [Valor 002]; por el delito de INVASIÓN A UN ÁREA DE CONSERVACIÓN O PROTECCIÓN en perjuicio de LOS RECURSOS NATURALES. Se resuelve; Redacta el Juez de Apelación de Sentencia Marco Mairena Navarro.; y,
CONSIDERANDO:
I.Los encartados [Nombre 001] y [Nombre 002], interponen “recurso de apelación de sentencia” contra el voto número 19-2026 dictado por el Tribunal de Juicio de Cartago, sede de Turrialba, a las 11:04 horas del 25 de junio del 2026, mediante el cual se declaró inadmisible la impugnación planteada por el licenciado Oscar Enrique Pessoa Arias, defensor de los justiciables, contra la resolución de las 9:30 horas del 7 de mayo de este año, emitida por el Juzgado Penal de Turrialba, en la cual, aplicando el numeral 140 del Código Procesal Penal dispuso lo siguiente: “Se le ordena a [Nombre 001] cédula [Valor 003] y [Nombre 002] cédula [Valor 004], proceder a derribar las edificaciones que se encuentren dentro del área de protección de la quebrada, realizando también siembra de árboles en el lugar, lo anterior dentro de un plazo de dos meses a partir de la notificación personal de la resolución que resuelva esta petición,, BAJO PENA TANTO DE INCURRIR EN EL DELITO DE DESOBEDIENCIA A LA AUTORIDAD ASÍ COMO DE LA IMPOSICIÓN DE MEDIDAS CAUTELARES MÁS GRAVOSAS PARA ELLA.- Notifíquese, esta resolución a la víctima de domicilio conocido que haya pedido ser informada del proceso penal así como al resto de las partes apersonadas en el proceso.” [sic].
II.El recurso resulta inadmisible. Al proceder al análisis de admisibilidad del recurso emplazado ante esta Cámara, debe indicarse que la Ley número 8837 de 3 de mayo de 2010, vigente desde el 9 de diciembre de 2011, al introducir el recurso de apelación de sentencia determinó que coexistan actualmente en nuestro sistema procesal penal dos diferentes tipos de recurso de apelación: 1. El que procede contra las resoluciones interlocutorias de los jueces de la etapa preparatoria e intermedia, conforme a lo dispuesto en el numeral 453 del Código Procesal Penal, que será de conocimiento de los tribunales penales, con integración unipersonal (artículo 96 bis de la Ley Orgánica del Poder Judicial). 2. El que procede contra las sentencias y los sobreseimientos dictados en la fase de juicio, que resuelven los aspectos penales, civiles, incidentales y demás que la ley determine, conforme a lo estatuido por el artículo 458 del Código Procesal Penal, recurso que es de conocimiento del Tribunal de Apelación de Sentencia Penal (artículo 93 de la Ley Orgánica del Poder Judicial).
De lo anterior se concluye que no toda resolución dictada por un tribunal de juicio es recurrible ante esta Cámara, sino únicamente las sentencias y los sobreseimientos emitidos en la etapa de juicio. En el presente caso, la resolución impugnada no posee tal carácter. Lo resuelto en el voto número 19-2026 por el Tribunal de Juicio de Cartago, sede de Turrialba, fue declarar la inadmisibilidad de un recurso de apelación interpuesto por la defensa contra una resolución del Juzgado Penal. En consecuencia, en aplicación del principio de impugnabilidad objetiva, dicho auto no es susceptible de recurso por esta vía.
POR TANTO:
Se declara inadmisible el recurso de apelación de sentencia planteado por los encartados [Nombre 001] y [Nombre 002]. Notifíquese.
