Criminal case number 25-000125-1262-PE brought against [Nombre 001], of legal age, married, Costa Rican, identity card [Valor 001], and [Nombre 002], of legal age, married, Costa Rican, identity card [Valor 002]. The Court is composed of Judges Maureen Sancho González, Susana Wittmann Stengel, and Christian Fernández Mora. Appearing at the appellate level was attorney Beatriz Sarmiento Chávez, criminal prosecutor, director of the private prosecution and civil damages claim.
BACKGROUND
I.By judgment number 162-2026, issued at 13:40 on 06 April 2026, the Criminal Court of the Second Judicial Circuit of the Southern Zone ordered: “THEREFORE: In accordance with the foregoing, the cited provisions, and Articles 39 and 41 of the Political Constitution; Article 8(1) of the American Convention on Human Rights; Article 10 of the American Declaration of the Rights and Duties of Man; Article 9(2) of the International Covenant on Civil and Political Rights; Articles 1, 4, 51, 6, 9, 236, 265, 269, 360 to 366, 422 et seq. of the Code of Criminal Procedure; Articles 1, 30, and 110 of the Criminal Code; and Article 150 of the Fisheries Law, it is resolved, in application of the universal principle of in dubio pro reo, to acquit [Nombre 001] AND [Nombre 002] of all punishment and liability for ONE OFFENSE OF TRANSPORTING AQUATIC FAUNA, to the detriment of NATURAL RESOURCES. Any precautionary measure in force against the defendants, if any, is ordered lifted.
The private prosecution and civil damages claim brought by the Procuraduría General de la República are dismissed. The Procuraduría General de la República is exempted from payment of costs because it is considered to have had a plausible reason to litigate. The return of a white-and-blue panga is ordered to whoever can show the better right, upon presentation of suitable documentation and compliance with the administrative requirements. It has no registration; it comes with a Costa Rican flag six meters long (6m) and two point five meters wide (2,5m), a twenty (20) horsepower Yamaha four-stroke long-shaft engine with a damaged propeller, das metal anchors, a red tank, a plastic paddle, and a fifty-five-meter (55m) rope. II.Only the private prosecution and civil claimant appealed the indicated ruling.
III.By order issued at 15:15 on 7 May 2026, the Criminal Court of the Second Judicial Circuit of the Southern Zone, Flagrancy, served notice of the appeal, and no response was filed.
IV.After the deliberation required by law under Article 465 of the Code of Criminal Procedure, this Chamber considered the issues raised in the appeal.
V.The proceedings have observed the formalities and requirements of law.
The opinion was drafted by Sentencing Appeals Judge Sancho González; REASONS Admissibility of the appeal.
The judgment was delivered orally as part of the expedited Flagrancy proceedings and was therefore notified on 06 April 2026 when it was read out. The 15-business-day period for filing an appeal expired on 27 June 2026, the date on which the appeal brief was filed with the issuing court, thus satisfying the requirements of objective appealability. In addition, it was filed by a duly constituted party to the proceedings—the State’s representative acting as private prosecutor and civil claimant—so subjective standing is also established.
Appeal filed by the Procuraduría General de la República.
Attorney Beatriz Sarmiento Chávez, criminal prosecutor, director of the private prosecution and civil damages claim, appealed the judgment in question. As her sole ground, she alleges “disagreement with the assessment of the evidence due to erroneous intellectual and/or analytical reasoning, in accordance with Articles 142-, 184, 363, and 459 of the Code of Criminal Procedure.” She says the court wrongly concluded that the transportation of aquatic fauna could not be established because it was not proven who operated the seized vessel. She maintains that this was established by documentary and testimonial evidence, specifically the testimony of witness [Nombre 004], an official of the National System of Conservation Areas (hereinafter SINAC), who saw defendant [Nombre 002] crouching in the water to avoid detection by the spotlights he had turned on, and defendant [Nombre 001] pushing the vessel (without registration) toward the water to flee after he had been secretly watching them.
She notes that hammerhead sharks, a species subject to a closed season and which the accused had not been authorized to catch, were indeed on the floor of the vessel, as certified by biologist Daniel López Bermúdez of the Costa Rican Institute of Fisheries and Aquaculture (hereinafter INCOPESCA). In the appellant’s view, there were clearly no other people; it was the middle of the night, and the women could not have reached that point except in that means of transport with the merchandise. She considers illogical the judge’s insistence that the evidence identify which of them operated the boat, because if the witness had turned on the light to determine that, he would have jeopardized the arrest. She quotes the offense set out in Article 150 of the Fisheries and Agriculture Law and emphasizes that subsection (a) penalizes anyone who illegally transports aquatic fauna, regardless of who operates the vessel, the distance traveled, or the point of origin or destination.
As to the dismissal of the civil damages claim, she argues that the court said it did not “share” the assessment of environmental damage because it was not objective, the expert report did not meet the requirements, and it could not be compared with the felling of trees. She points out that the inclusion of forestry data in that evidence does not undermine the calculations presented and that the judicial authority did not explain why the [Nombre 009] method was inapplicable. She also says the judgment was not adequately reasoned and asks that it be declared ineffective on both points.
The appeal is granted. The first thing this Chamber notes is that the judgment, preserved in file 250001251262PE-06042026013804-2_Multi, lasted 00:44:36. The explanation of the intellectual assessment began at timestamp 00:21:58. At the outset, the court below stated that there had been doubt about the facts; but then it said the legal classification had been changed before trial began, the defense had been given time to prepare its strategy in light of that change, and as a result of the change there was no longer correspondence with what the prosecutor had charged, which was fishing rather than transportation of the listed aquatic species, because the factual account remained unchanged. It added that the SINAC report did not state that the defendants had been given the warnings required by law, although, without explaining how one issue related to the other, it acknowledged that there had been a criminal report authorizing the police to approach the accused.
The judge in charge continued and stated that it was unclear who had operated the boat and that, hypothetically, it could have been a third party, such as “[Nombre 008]” (the husband of one of the accused), or the two women could already have been at the site and the boat might have arrived later, operated by an unidentified person. The judge then briefly listed the documentary evidence and concluded that the absence of permits and registration for the boat was immaterial in light of the decision reached. The civil damages claim was dismissed for lack of a causal link; but the judge added that SINAC’s assessment was not objective because it assessed damage to fauna using forestry parameters, did not take all species into account, and did not consider whether the fish were “juveniles” or “mature”; the judge also waived costs. A ruling under these circumstances does not meet the minimum standards for reasoning and assessment of evidence and is therefore ineffective, as the appellant argued.
To begin, it must be noted that the legal classifications assigned to the charged facts admitted for resolution at trial are provisional and may indeed change up to the issuance of judgment, provided the factual account remains unchanged. However, the fact that the prosecutor gave a different classification before the testimonial evidence was heard has nothing to do with whether the judgment corresponds to the charge, because if the judicial authority considered the alleged historical event proven, it was for that authority to give it the definitive legal classification, if a provision existed that prescribed a penalty for that conduct, regardless of what the Public Ministry had suggested. In any event, there was a private prosecution in the case file, and it uses the verbs “to transfer” and “to transport”; from the time it was filed, it referred to Article 150 of the special law in question, which uses, among other terms, the latter word as the operative verb describing the unlawful conduct. The trial court’s reasoning is therefore incomprehensible, especially because it itself stated that the facts had not been corrected.
The appellant is right that “transport” does not mean the same thing as “operate”; someone may carry something from one place to another, for example, by hiring a third party, while retaining control over the origin and destination and giving instructions to that third party. This logical reasoning was overlooked in the judgment amid a conflation of issues that makes it impossible to clearly understand the logical path of the reasoning set out there. Moreover, the supposed doubt was based on imagined scenarios created by the judge as possible alternatives, but which definitely did not follow from either the direct or circumstantial evidence under rational assessment in accordance with the rules of logic, experience, and science.
Of course, merely mentioning the evidence admitted in court adds to the judgment’s reasoning defects, and that defect extends to the disposition of the civil damages claim, as the Procuraduría General de la República argued, because it was automatically dismissed on the ground that “there is no causal link,” based on an erroneous and incomplete analysis of the criminal evidence. The court then, without need and without any discernible purpose in light of its decision to reject the monetary claim, elaborated on subjective considerations concerning the failure of an expert report to meet requirements. The report had suggested a monetary valuation of damage in the abstract, and it is currently unknown which requirements the court meant because the judgment did not specify them. Accordingly, in view of these shortcomings, the entire judgment under appeal is set aside, and a new trial is ordered before a differently composed court to reconsider both the criminal and civil claims.

A las nueve horas con veintinueve minutos del trece de agosto del dos mil veintiséis.
Causa penal número 25-000125-1262-PE seguida en contra de [Nombre 001], mayor de edad, casada, costarricense, cédula [Valor 001] y de [Nombre 002], mayor de edad, casada, costarricense, cédula [Valor 002]. Integran el Tribunal las juezas Maureen Sancho González, Susana Wittmann Stengel y el juez Christian Fernández Mora. Se apersonó, en sede de apelación, la licenciada Beatriz Sarmiento Chávez, procuradora penal, directora de la querella y la acción civil resarcitoria .
RESULTANDO
I.Que mediante sentencia número 162-2026 de las 13:40 horas del 06 de abril de 2026, el Tribunal Penal del Segundo Circuito Judicial de la Zona Sur, dispuso: "POR TANTO: De conformidad con lo expuesto, normas citadas y artículos 39 y 41 de la Constitución Política 8 inciso 1) de la Convención Americana de Derechos Humanos; 10 de la Declaración Americana de Derechos Humanos; 9 inciso 2) del Pacto Internacional de Derechos Civiles y Políticos: 1, 4, 51 6, 9, 236, 265, 269, 360 a 366, 422 y siguientes del Código Procesal Penal: 1, 30, 110 del Código Penal, 150 de la Ley de Pesca se resuelve, en aplicación del principio universal del principio de In dubio pro reo: Absolver de toda pena y responsabilidad a [Nombre 001] Y [Nombre 002] por UN DELITO DE TRANSPORTE FAUNA ACUATICA en perjuicio de LOS RECURSOS NATURALES. Se ordena dejar sin efecto cualquier medida cautelar que pese en contra de las encartadas si las hubiere.
Se declara sin lugar la Querella y Acción Civil Resarcitoria incoada por la Procuraduría General de la Republica. Se exime del pago de las costas a la Procuraduría General de la Republica por considerar que ha tenido una razón plausible para litigar. Se ordena la devolución a quien mejor derecho corresponda con documentación idónea y cumpliendo con los requisitos administrativos de una panga color blanco con azul; sin matricula, con una bandera de Costa Rica de seis metros de largo (6m) y dos punto cinco metros de ancho (2,5m), con un motor de veinte (20) caballos de fuerza, marca Yamaha, cuatro tiempos, pata larga, propela golpeada, das anclas de metal, una tanqueta roja, un canalete plástico, un mecate de cincuenta y cinco metros (55m). Se le otorga el plazo de tres meses para reclamar dicho bien. Transcurrido este plazo, si no se cumple con lo indicado se ordena el comiso a favor del estado propiamente a SINAC. Por ser una resolución oral quedan las partes debidamente notificadas. Erick Granados Umaña. Juez del Tribunal de Juicio del II Circuito Judicial de la Zona Sur." [sic].
II.Que, contra el fallo indicado, solo la parte querellante y actora civil interpuso recurso.
III.El Tribunal del Segundo Circuito Judicial de la Zona Sur, Flagrancia, emplazó el recurso mediante resolución de las 15:15 horas del siete de mayo de 2026 y no existe contestación.
IV.Realizada la deliberación de ley según lo dispuesto en el numeral 465 del Código Procesal Penal, esta cámara se planteó las cuestiones formuladas en el recurso.
V-. En los procedimientos se han observado las formalidades y prescripciones de ley.
Redacta la Jueza de Apelación de Sentencia Sancho González;
CONSIDERANDO
Admisibilidad del recurso.
La sentencia se dictó oralmente como parte del trámite expedito de Flagrancias y, por eso, quedó notificada el mismo 06 de abril de 2026 con su exposición. El plazo de 15 días hábiles para impugnar vencía el 27 de junio de 2026, fecha en la cual se presentó el libelo impugnatorio ante el tribunal emisor, cumpliéndose así con los requisitos de impugnabilidad objetiva. Además, fue interpuesto por una parte procesal debidamente constituida —la representación del Estado como querellante y actora civil—, por lo que la legitimación subjetiva, también se verifica.
Recurso de apelación promovido por la Procuraduría General de la República.
La licenciada Beatriz Sarmiento Chávez, procuradora penal, directora de la querella y la acción civil resarcitoria, impugnó la sentencia de marras. Como único motivo, alega una “inconformidad con la valoración de la prueba por errónea fundamentación intelectiva y/o analítica, de conformidad con lo establecido en los artículos 142-, 184, 363 y 459 del Código Procesal Penal”. Señala que el tribunal, de manera errónea, concluyó que no se podía acreditar el transporte de fauna acuática porque no se comprobó quién manejaba la embarcación incautada, pero estima que ello sí quedó demostrado con la prueba documental y testimonial, en concreto, con la declaración del testigo [Nombre 004], funcionario del Sistema Nacional de Áreas de Conservación (en adelante SINAC) que vio a la encartada [Nombre 002] agachándose en el agua para no ser detectada por los focos que él encendió, así como a la endilgada [Nombre 001] empujando la embarcación (sin matrícula) hacia el agua para darse a la fuga, luego de vigilarlas sigilosamente.
Hace notar que, en el piso de esta había, en efecto, tiburones martillo, especie en veda y cuya pesca no había sido autorizada a las acriminadas, como lo certificó el biólogo Daniel López Bermúdez del Instituto Costarricense de Pesca y Acuicultura (en lo sucesivo INCOPESCA). Para la impugnante, es claro que no había más personas, estaban en medio de la noche y no tenían cómo haber llegado a ese punto si no era en tal medio de transporte con la mercancía. Considera que la exigencia que hizo el juez de que se dijera cuál de ellas operaba la lancha resulta ilógica, porque si el testigo encendía la luz para determinarlo, habría dado al traste con la detención. Transcribe el tipo penal contenido en el artículo 150 de la Ley de Pesca y Agricultura y resalta que, en el inciso a) de la norma se sanciona a quien transporte en forma ilegal fauna acuática, con independencia de la conducción, la distancia recorrida, el punto de origen o de destino.
En relación con la declaratoria sin lugar de la acción civil resarcitoria, aduce que el tribunal estimó que no “compartía” la valoración del daño ambiental, porque no era objetivo, que el peritaje no cumplía con los requisitos y que no se podía comparar con la tala de unos árboles. Puntualiza que, el hecho de que se consignaran en esa prueba datos forestales no demerita los cálculos ahí vertidos y que la autoridad judicial no explicó por qué el método [Nombre 009] no era aplicable. Señala que no existió una adecuada fundamentación tampoco y pide que se declare la ineficacia de la sentencia en los dos aspectos. Se declara con lugar. Lo primero que nota esta Cámara es que la sentencia, respaldada en el archivo 250001251262PE-06042026013804-2_Multi, tuvo una duración de 00:44:36. La exposición de la labor intelectiva se expuso a partir de la altura 00:21:58. Al inicio, el a quo sostiene que ha existido una duda en relación con los hechos; pero luego indica que calificación jurídica se varió antes de iniciar el juicio, que se le dio espacio a la defensa para preparar su estrategia de cara a dicha variación y que, producto de ese cambio, dejó de existir correlación con lo acusado por la fiscalía que fue la pesca y no el transporte de las especies acuáticas enlistadas, porque el cuadro fáctico se mantuvo invariable.
Agregó que en el informe del SINAC no consta que se les haya hecho a las sindicadas las advertencias de ley, aunque, sin explicar la relación de un tema con el otro, reconoció que sí hubo una noticia criminal que autorizaba el abordaje policial de las acusadas. Continuó su disertación e indicó el juez a cargo, que no quedó claro quién conducía la lancha y que, hipotéticamente, podría haber sido un tercero como el “señor [Nombre 008]” (esposo de una de la acriminadas) o que las dos ya estuvieran en el sitio y la lancha llegara después dirigida por alguien no identificado. Luego enlistó la prueba documental de manera somera para concluir que el tema de la ausencia de permisos y matrícula del bote eran intrascendentes por la decisión tomada. Desestimó la acción civil resarcitoria a falta de nexo causal; pero adicionó que la valoración del SINAC no era objetiva por valorar un daño a la fauna con parámetros forestales que no tomó en cuenta todas las especies ni si los peces eran “juveniles” o “maduros” y, además, eximió en costas.
Un fallo en tales condiciones no supera los estándares mínimos de fundamentación y valoración probatoria y, por ende, resulta ineficaz, tal y como lo ha invocado la apelante. Para empezar, se debe advertir que las calificaciones jurídicas que se brindan a los hechos acusados y admitidos para ser dilucidades en la fase plenaria, son provisionales y, en efecto, pueden variar hasta antes del dictado de una sentencia —en el tanto el cuadro fáctico se mantenga—; sin embargo, la circunstancia de que la fiscalía haya dado una distinta antes de evacuar la prueba testimonial, nada tiene que ver con la correlación de la acusación con la sentencia, porque la autoridad judicial, si tenía por acreditado el evento histórico imputado, era quien debía dar el encuadre típico definitivo, si es que existía una norma que previera la sanción de dicha conducta, con independencia de lo sugerido por el Ministerio Público.
En todo caso, existía en autos una querella y, en ella, se lee el uso de los verbos “trasegar” y “transportar” y, desde su interposición, se aludió al referido artículo 150 de la ley especial en cuestión que utiliza, en su descripción abstracta y entre otros, este último vocablo como rector de la conducta ilícita, por lo que no se entiende la derivación hecha por el tribunal de instancia, sobre todo porque él mismo aseguró que los hechos no se corrigieron. Le asiste razón a la recurrente en el sentido de que “transportar” no es lo mismo que “conducir”, por lo que alguien bien podría llevar algo de un lugar a otro, por ejemplo, contratando los servicios de una tercera persona, siendo la primera quien mantiene el dominio del origen y el destino dando indicaciones a la segunda, razonamiento lógico que fue pasado por alto en la sentencia en una entremezcla de temas que impide conocer, con claridad, el iter lógico del razonamiento ahí esbozado; amén de que la supuesta duda la sustentó en escenarios imaginarios creados por el juzgador como alternativas posibles, pero que definitivamente no derivaban, ni de la prueba directa ni de la indiciaria desde la sana crítica racional.
Por supuesto que, la simple mención de los documentos judicializados, abona a los defectos de motivación del fallo y ese vicio se extiende al destino de la acción civil resarcitoria, como lo reclamó la Procuraduría General de la República, porque se descartó en automático al decir que “no hay nexo de causalidad”, con base en un análisis errado e incompleto del elenco probatorio penal y, sin necesidad ni que se entienda el objetivo (de cara a lo que ya había decidido, que era desechar el reclamo pecuniario), amplió sobre consideraciones subjetivas relativas al incumplimiento de requisitos de un peritaje que sugirió la valoración monetaria de un daño en abstracto y que, al momento, se desconoce a cuáles se refería, porque no se especificaron en la sentencia. Así las cosas y, de cara a tales falencias, se anula la totalidad sentencia venida en alzada y se ordena la celebración de un nuevo juicio ante una integración distinta para que se conozcan, de nuevo, tanto los extremos penales como los civiles.
