SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At twelve hours and twelve minutes on 15 July 2026.- POSSESSORY INFORMATION PROCEEDING filed by RANCHO BAHÍA CHAL SOCIEDAD ANÓNIMA, corporate identification number three - one hundred one - eight hundred seventy thousand eight hundred eighty-seven, represented by Hilaria Umberta Monrroy Mendoza, of legal age, single, pensioner, residence identification number one eight six two zero two five eight four nine three one, resident of Puntarenas. I.The filing company brought these possessory information proceedings so that, by this means, the land described as follows may be registered in the Public Property Registry: “Nature: Mountain. Located in Bahía Chal, District: 03 Sierpe, Canton: 05 Osa, Province: 06 Puntarenas. BORDERS: to the North: Public Road, with a linear measurement of 154.20 meters; South: Playa Monos S.A; East: Playa Monos S.A; and West: Gary Ralph Fielding and Roberth Boyd Murphy. MEASURES: seventeen thousand thirty-eight square meters, as indicated on cadastral plan number P-6092-2024.” (See file downloaded in pdf mode, first-instance judgment, image 138).

II.The Procuraduría General de la República appeared in the proceeding on the terms set out in the file and did not oppose these proceedings (downloaded in pdf mode, image 64; in turn, the Instituto de Desarrollo Rural, image 86).

III.Judge Oscar Andrés Segura Navarro of the Agrarian Court of the Second Judicial Circuit of the Southern Zone, Corredores, by judgment number 2026000178, at eight hours and thirty-eight minutes on 21 April 2026, ruled: “THEREFORE: ...The Possessory Information is approved, subject to the encumbrances referred to in Article 17 of the Law on Possessory Information and without prejudice to third parties with a better right. The Property Registry is ordered to register for the first time, in the name of RANCHO BAHÍA CHAL SOCIEDAD ANÓNIMA, corporate identification number three - one hundred one - eight hundred seventy thousand eight hundred eighty-seven, domiciled in [...], represented by Hilaria Umberta Monrroy Mendoza, of legal age, single, pensioner, resident of Puntarenas, residence identification number one eight six two zero two five eight four nine three one, the property described as follows: Nature: mountain land, and two houses with grounds.

Located in Bahía Chal, District: 03° Sierpe, Canton: 05° Osa, Province: 06° Puntarenas. BORDERS: North: Public Road, with a linear measurement of 154.20 meters; South: Playa Monos S.A; East: Playa Monos S.A; and West: Gary Ralph Fielding. MEASURES: SEVENTEEN THOUSAND THIRTY-EIGHT SQUARE METERS (17.038m2), as indicated on cadastral plan number P-6092-2024. Since the property borders a public road on its northern side, with a right-of-way of 30 meters, it is subject to the reservations concerning public-road rights-of-way provided for in Articles 4 and 7(b) of the General Public Roads Law and 19(a) of the Law on Possessory Information. Since the property is within the protected area of the Golfo Dulce Forest Reserve, changing land use is not permitted on forest-covered land pursuant to Article 19 of the Ley Forestal; cutting or removing trees is prohibited, and prior authorization must be requested from the State Forestry Administration (AFE).

The property that is the subject of this proceeding is valued at ¢40.000.000 (forty million colones). Let the formal copy of this judgment serve to register the related property in the Property Registry.” (See file downloaded in pdf mode, images 138 to 150).-

IV.In view of the manner in which the matter will be decided, no ruling is made on the set of facts deemed proven.-

V.The State’s representative, assistant procurator Attorney Susana Fallas Cubero, filed an appeal with a concomitant request for nullity, stating as follows: “I file an appeal and allege its nullity on the following grounds: The testimonial evidence is insufficient to prove prior acquisitive prescription before the decree establishing the Golfo Dulce Forest Reserve, No. 8494-A, entered into force on 1 June 1978. The three witnesses should have addressed the requirements for possession (public, peaceful, uninterrupted, and as owner), exercised between 1968 and 1978, and the chain of transfers of that possession in relation to the property sought to be titled. The testimonial evidence received in this case establishes neither that Marcos Chacón’s possession met the conditions required by law for acquisitive prescription nor the entire chain of transfers. The witnesses must establish the period of occupation of each transferor, according to various votes of the Agrarian Court: ‘in order to rely on transferred possession… it is necessary to prove the chain of transferors clearly, because Article 7 of the aforementioned law [Law on Possessory Information] does not modify the requirements of Article 856 of the Civil Code, and for that reason the person seeking to obtain title to property and wishing to rely on the possession of the transferors must clearly prove the chain of transferors and all the details of that situation in order to benefit from it.’ (Vote No. 500-F-2015 at 7 hours 48 minutes on 27 May 2015.

To the same effect, Vote No. 427-F-15 at 16 hours 44 minutes on 30 April 2015). ‘It is very important to identify the previous possessors as well as the period of possession of each of them in order to rely on derived possession, as provided in Vote number 4587-97 issued by the Sala Constitucional (...) Hence the need to establish, through three witnesses, possession for ten years before the property became subject to the public-domain designation, which the filing party has failed to do.’ (Vote No. 171-F-2015 at 7 hours 49 minutes on 26 February 2015. To the same effect, Vote No. 358-F-2015 at 16 hours 10 minutes on 17 April 2015). ‘The witnesses’ references to the names of previous possessors are not sufficient, since they do not provide complete information about all those who participated (sic) in that chain of possession, or the periods of possession of each of them, nor the type of possession they exercised, particularly since the property is located within the Grecia Forest Reserve.’ (Vote No. 516-F-13 at 9 hours 34 minutes on 31 May 2013). ‘it is necessary to prove the chain of transferors clearly, because Article 7 of the aforementioned law does not modify the requirements of Article 856 of the Civil Code, and for that reason the person seeking to obtain title to property and wishing to rely on the possession of previous transferors must clearly prove the chain of transferors and all the details of that situation in order to benefit from it, which, as explained, did not occur in this matter.’ (Vote No. 255-f-13 at 8 hours 46 minutes on 13 March 2013). ‘It is very important to identify the previous possessors as well as the period of possession of each of them in order to rely on derived possession.’ (Vote No. 80-f-13 at 12 hours 22 minutes on 31 January 2013.

Furthermore, Mr. Ramón Steller Jiménez’s statement that Marcos Chacón ‘had pastures and large coconut palms planted on the beach’ casts doubt on whether his testimony refers to the same property sought to be titled, which is located more than 670 meters from the coastline. This objection was not analyzed in the challenged judgment, and it is not an insignificant detail, since it is essential to establish that the property to which the witness refers is the same land sought to be titled. The failure to analyze our arguments entails nullity of the judgment under Agrarian Court precedents (Votes 52-F-2021 at 13 hours 50 minutes on 27 January 2021, 79-F-2021 at 19 hours 25 minutes on 28 January 2021, 739-F-2022 at 7 hours 33 minutes on 1 August 2022, 2023000745 at 10 hours 49 minutes on 6 September 2023, 2024000011 at 16 hours 35 minutes on 11 January 2024, and 2025000721 at 15 hours 3 minutes on 31 July 2025, among others).

For the foregoing reasons, I request that the file be sent to the Superior Court so that it may annul judgment No. 2026000178 and analyze whether the witnesses established the conditions required by Articles 853, 854, 855, 856, and 860 of the Civil Code with respect to Marcos Chacón, and whether the land sought to be titled is the same land referred to by witness Steller.” (See file downloaded in pdf mode, images 155 to 160).-

VI.The appellant is correct in her grounds for nullity. The judgment lacks reasoning because it neither mentioned nor analyzed the challenge raised by the State body regarding the testimony of Mr. Ramón Steller Jiménez and the location that the witness assigns to the property to be titled. These matters are of particular concern, yet the trial judge said nothing about them. The a-quo did not resolve any of the points submitted for discussion at the final hearing.- It did not resolve these matters; for the judgment to be valid, it must address all matters submitted for analysis in the proceeding. This is especially so where the State’s representative opposes approval of the titling: the judge should have explained the reasons for disregarding or disagreeing with its arguments. For that reason, this Court could not rule on those issues, as doing so would bypass the first instance, and the parties are entitled to have both the a-quo and this Court express their views on those matters.

Article 54 of the Agrarian Jurisdiction Law requires that all points debated be resolved, including in this non-contentious proceeding, which was submitted for the judge’s consideration.- The identified defect constitutes a violation of due process: a judgment was issued that omitted to rule on all the matters requested and challenged by the Procuraduría.- For all the reasons stated here, the judgment must be annulled, and the file sent back to the court below so it may rule in accordance with law and issue an express, reasoned decision on the grounds or reasons for nullity raised by the State party. In this regard, Vote No. 766-F-15 at 13:28 on 31 July 2015 may be consulted as a precedent in similar terms, as well as, more recently, Vote No. 2023000745 at 10:49 on 6 September 2023.-

THEREFORE:

The ground for concomitant nullity is upheld. The judgment issued is annulled.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las doce horas doce minutos del quince de julio de dos mil veintiséis.- INFORMACIÓN POSESORIA promovida por RANCHO BAHÍA CHAL SOCIEDAD ANÓNIMA, cédula jurídica número tres - ciento uno - ochocientos setenta mil ochocientos ochenta y siete, representada por Hilaria Umberta Monrroy Mendoza, mayor, soltera, pensionada, cédula de residencia número uno ocho seis dos cero dos cinco ocho cuatro nueve tres uno, vecina de Puntarenas. Intervienen en el proceso la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Susana Fallas Cubero, mayor, casada, abogada, carné número nueve mil seiscientos sesenta y nueve, cédula de identidad número uno - ochocientos setenta y tres - cero veintidós, vecina de San José, en su condición de procuradora adjunta y el INSTITUTO DE DESARROLLO RURAL (INDER) representado por su apoderado especial judicial Guillermo Goyenaga Calvo, mayor, casado, abogado, colegiado siete mil trescientos cincuenta y nueve, vecino de Santa Bárbara de Heredia. Actúa como apoderada especial judicial de la parte promovente la licenciada Jackeline Brenes Molina, colegiada treinta mil cuatrocientos veinte. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur.- Redacta el juez Picado Vargas; y,

CONSIDERANDO:

I.La sociedad promovente interpuso las presentes diligencias de información posesoria para que por medio de esta vía se proceda a inscribir en el Registro Público de la Propiedad el terreno que se describe así: " de Naturaleza: Montaña. Situada en Bahía Chal, Distrito: 03 Sierpe, Cantón: 05 Osa de la Provincia: 06 Puntarenas. COLINDA: al Norte: Calle Publica, con una medida lineal de 154.20 metros, Sur: Playa Monos S.A, Este: Playa Monos S.A y Oeste: Gary Ralph Fielding y Roberth Boyd Murphy. MIDE: diecisiete mil treinta y ocho metros cuadrados, tal como lo indica el plano catastrado número P-6092-2024." (Ver expediente descargado en modo pdf, sentencia de primera instancia imagen 138).

II.La Procuraduría General de la República se apersonó al proceso en los términos que corren en expediente, y no ofrecieron oposición a las presentes diligencias, (descargado en modo pdf imágenes 64; a su vez el Instituto de Desarrollo Rural imagen 86).

III.El juez Oscar Andrés Segura Navarro, del Juzgado Agrario del Segundo Circuito Judicial de la zona sur, Corredores, mediante sentencia número 2026000178, de las ocho horas con treinta y ocho minutos del veintiuno de abril del año dos mil veintiséis, resolvió: "POR TANTO: ...Se aprueba la Información Posesoria con las afectaciones a que se refiere el artículo 17 de la Ley de Informaciones Posesorias y sin perjuicio de terceros de mejor derecho, se ordena al Registro de la Propiedad inscribir, por primera vez, a nombre de RANCHO BAHÍA CHAL SOCIEDAD ANÓNIMA, cédula jurídica tres - ciento uno- ochocientos setenta mil ochocientos ochenta y siete, domiciliada en [...], representada por Hilaria Umberta Monrroy Mendoza, mayor, soltera, pensionada, vecina de Puntarenas, cédula de residencia uno ocho seis dos cero dos cinco ocho cuatro nueve tres uno, la finca que se describe de Naturaleza: terreno de montaña, y dos casas con solar.

Situada en Bahía Chal, Distrito: 03° Sierpe, Cantón 05° Osa de la Provincia 06° Puntarenas. COLINDA: Norte: Calle Publica con una medida lineal de 154.20 metros, Sur: Playa Monos S.A, Este: Playa Monos S.A y Oeste: Gary Ralph Fielding. MIDE: DIECISIETE MIL TREINTA Y OCHO METROS CUADRADOS (17.038m2), tal como lo indica el plano catastrado número P-6092-2024. Dado que el inmueble colinda con calle pública por el rumbo norte con un derecho de vía de 30 metros, queda afectado a las reservas en cuanto a derecho de vía de las calles públicas que disponen los artículos 4 y 7 inciso b) de la Ley General de Caminos Públicos y 19, inciso a) de la Ley de Informaciones Posesorias. Dado que el inmueble se encuentra dentro del área de protección de la Reserva Forestal Golfo Dulce, en terrenos cubiertos de bosque no se permitirá cambiar el uso del suelo según artículo 19 de la Ley Forestal, queda prohibida la corta o eliminación de árboles, para lo que previamente deberá solicitar la autorización de la Administración Forestal del Estado (AFE).

El inmueble objeto de este proceso se estima en la suma de ¢40.000.000 (cuarenta millones de colones). Sirva la ejecutoria de esta sentencia para inscribir en el Registro de la Propiedad la finca relacionada."(Ver expediente descargado en modo pdf, imágenes 138 a 150).-

IV.Por la forma en que se resolverá, no se emite pronunciamiento sobre el elenco de hechos tenidos por probados.-

V.La representante del Estado, procuradora adjunta la licenciada Susana Fallas Cubero, formuló recurso de apelación con nulidad concomitante, manifestando lo siguiente: "Presento recurso de apelación y alego su nulidad, con fundamento en lo siguiente: La prueba testimonial es insuficiente para demostrar la usucapión previa a la entrada en vigencia del decreto creador de la Reserva Forestal Golfo Dulce, n.° 8494-A, el 1° de junio de 1978. Los tres testigos debieron referirse a los requisitos de la posesión (pública, pacífica, ininterrumpida y en calidad de dueño), ejercida entre 1968 y 1978 y a la cadena de traspasos de esa posesión, en relación con el inmueble que pretende titularse. La prueba testimonial recibida en este caso no acredita, ni que la posesión de Marcos Chacón reuniera las condiciones requeridas por ley para usucapir, ni la totalidad de la cadena de traspasos. Los testigos deben acreditar el tiempo de ocupación de cada transmitente según diversos votos del Tribunal Agrario: “para poder hacer valer la posesión trasmitida…es necesario probar de forma diáfana la cadena de transmitentes, porque el ordinal 7 de la ley en sita [Ley de Informaciones Posesorias] no modifica lo exigido en el artículo 856 del Código Civil, y por tal razón la persona que desea obtener un título de propiedad y desea hacer valer la posesión de las personas transmitentes, debe probar de forma diáfana la cadena de transmitentes y todos los detalles de esa situación, para aprovecharla”.

(Voto No. 500-F-2015 7 horas 48 minutos del 27 de mayo del 2015. En el mismo sentido el voto No. 427-F-15 de 16 horas 44 minutos del 30 de abril del 2015). "Es de mucha importancia hacer referencia a quienes fueron los anteriores poseedores así como el tiempo de posesión de cada uno de ellos para sí hacer valer una posesión derivada según lo dispuesto mediante Voto número 4587-97 dictado por la Sala Constitucional (...) De allí sea necesario la demostración con tres testigos sobre la posesión decenal con antelación a la afectación como bien de dominio público, lo que no ha sido cumplido por el promovente". (Voto No. 171-F-2015 de 7 horas 49 minutos del 26 de febrero del 2015. En el mismo sentido el voto No. 358-F-2015 de 16 horas 10 minutos del 17 de abril del 2015). “Las referencias de los nombres de anteriores poseedores a las que hacen mención los testigos, no son suficientes, pues no se brinda una información completa de todos los participaron (sic) en esa cadena posesoria, ni los tiempos de posesión que habían en cada uno de ellos, así como tampoco el tipo de posesión por estos ejercida, máxime el inmueble se ubica dentro de la Reserva Forestal Grecia”.

(Voto No. 516-F-13 de 9 horas 34 minutos del 31 de mayo del 2013). “es necesario probar de forma diáfana la cadena de transmitentes, porque el ordinal 7 de la ley en cita no modifica lo exigido en el artículo 856 del Código Civil, y por tal razón la persona que desea obtener un título de propiedad y desea hacer valer la posesión de los anteriores transmitentes, debe probar de forma diáfana la cadena de transmitentes y todos los detalles de esa situación, para aprovecharla, lo cual como se explicó no ocurrió en este asunto”. (Voto No. 255-f-13 8 horas 46 minutos del 13 de marzo del 2013). “Es de mucha importancia hacer referencia a quienes fueron los anteriores poseedores así como el tiempo de posesión de cada uno de ellos para así hacer valer una posesión derivada.” (Voto No. 80-f-13 de 12 horas 22 minutos del 31 de enero del 2013. Subrayado es del original). Por otra parte, la mención del señor Ramón Steller Jiménez de que Marcos Chacón “tenía potreros y cocos grandes sembrados en la playa” pone en duda que su declaración se refiera al mismo inmueble que pretende titularse, el cual se ubica a más de 670 metros de la línea de costa.

Esta objeción no fue analizada por la sentencia impugnada y no es un detalle insignificante, pues es imprescindible que se pueda establecer una identidad entre el inmueble al cual se refiere el testigo, y el terreno que pretende titularse. La falta de análisis de nuestros argumentos acarrea la nulidad del fallo, según precedentes del Tribunal Agrario (votos 52-F-2021 de 13 horas 50 minutos del 27 de enero del 2021, 79-F-2021 de 19 horas 25 minutos del 28 de enero del 2021, 739-F-2022 de 7 horas 33 minutos del 1° de agosto del 2022, 2023000745 de 10 horas 49 minutos del 6 de setiembre del 2023, 2024000011 de 16 horas 35 minutos del 11 de enero del 2024 y 2025000721 de 15 horas 3 minutos del 31 de julio del 2025, entre otros). Por lo expuesto, solicito se remita el expediente al Superior, con el fin de que anule la sentencia n.° 2026000178, para que se analice si los testigos acreditaron las condiciones requeridas por los artículos 853, 854, 855, 856 y 860 del Código Civil, respecto de Marcos Chacón, y si hay identidad entre el terreno que pretende titularse y el referido por el testigo Steller." (Ver expediente descargado en modo pdf, imágenes 155 a 160).-

VI.Lleva razón la recurrente en sus motivos de nulidad. La sentencia adolece de falta de fundamentación, ya que no mencionó ni analizó el cuestionamiento vertidos por el ente estatal acerca del testimonio del señor Ramón Steller Jiménez y la ubicación que dicho testigo le da a la finca a titular, los cuales son aspectos que llama mucho la atención y sobre el cual el juzgador de instancia tampoco dijo nada al respecto. El a-quo no resolvió ninguno de los puntos sometidos a discusión en la audiencia final.- Tales aspectos no los resolvió, por lo que la sentencia para que sea válida debe resolver todos los aspectos sometidos a análisis en el proceso, máxime si la representación estatal se está oponiendo a la aprobación de la titulación, debió fundamentarle los motivos por los cuales desantendió o no compartía sus argumentos. Por tal motivo, este Tribunal, no podría entrar a emitir pronunciamiento sobre tales extremos, pues se estaría omitiendo la primera instancia, siendo derecho de las partes que tanto el a-quo como el Tribunal vierta criterio sobre esos aspectos.

El artículo 54 de la Ley de Jurisdicción Agraria exige resolver todos los puntos que han sido objeto de debate, y en este caso de proceso no contencioso sometidos al conocimiento del juzgador o juzgadora.- El vicio apuntado configura violación al debido proceso dictandose una sentencia omisa al no resolver sobre todo lo peticionado y cuestionado por la Procuraduría.- Por todos los motivos aquí expuestos, deberá anularse la sentencia, para remitir el expediente al ad quo para que falle con arreglo a derecho, y proceda a pronunciarse de manera fundamentada y expresa de los fundamentos o motivos de nulidad aducidos por la parte Estatal. En ese sentido, puede consultarse como antecedente en iguales términos el Voto No. 766-F-15 de las 13:28 horas del 31 de julio del 2015 y más recientemente el Voto No. 2023000745 de las 10:49 hras del 6 de setiembre del 2023.-

POR TANTO:

Se acoge el motivo de nuidad concomitante. Se anula la sentencia dictada.
