The following are established as such: A.- By judgment (sentencia) No. 11-2019-IV issued at 08:15 hours on February 25, 2019, by the Sección IV of the Tribunal Contencioso Administrativo, the following was ordered: "POR TANTO (...) the counterclaim (contrademanda) filed by the Contraloría General de la República against Empresa Hotelera Dominical S.A., Punta Dominical S.A., Dieciocho Veintiuno S.A., Municipalidad de Osa, Instituto Costarricense de Turismo, and Instituto Nacional de Vivienda y Urbanismo is declared WELL-FOUNDED in all its aspects. Consequently: i) The substantial nonconformity (disconformidad sustancial) with the legal order (ordenamiento jurídico) is declared, and, as a result, the absolute nullity (nulidad absoluta) of the following administrative actions, as well as all related acts and proceedings that granted the authorization requested by Empresa Hotelera Dominical S.A. for the application of article 21 of Ley No. 6043 in the public zone (zona pública) of Punta Dominical, at the site where the restaurant and cabin facility known as 'La Parcela' is currently located: a) Agreement of the ICT Board of Directors, approved at ordinary session No. 5082, article 2, subsection I), held on February 5, 2001; b) Agreement of the ICT Board of Directors, approved at ordinary session No. 5154, article 2, subsection V, held on January 14, 2002; and c) Agreement of the Concejo Municipal of Osa, approved at extraordinary session No. 06-2002, held on April 5, 2002, item 12), by which that Municipality resolved to: authorize and approve the application of the regime set forth in article 21 of Ley No. 6043 to the area requested by Empresa Hotelera Dominical S.A., and authorize the commencement of the corresponding proceedings for the obtainment of the respective concession contract. ii) The substantial nonconformity with the legal order is declared, and as a result, the absolute nullity of the amendment to the Plan Regulador of Punta Dominical, made for the purpose of changing the established land use (uso del suelo) and incorporating a different use under the application of article 21 of Ley No. 6043, at the site where the restaurant and cabin facility known as 'La Parcela' is currently located.
Accordingly, the following administrative actions, as well as all related acts and proceedings connected thereto, are declared absolutely null: a) Agreement of the ICT Board of Directors, approved at ordinary session No. 5281, article 5, subsection IX, held on December 9, 2003; b) Official communication No. PU-C-D-532-2004 of April 22, 2004, issued by the Dirección de Urbanismo of INVU; c) Agreement of the Concejo Municipal of Osa, approved at ordinary session No. 08-2005, chapter VI), held on February 23, 2005, and the ratification granted at ordinary session No. 09-2005, chapter V), held on March 2, 2005; d) Agreement of the Concejo Municipal of Osa, approved at ordinary session No. 31-2008, held on August 6, 2008, and published in the Diario Oficial La Gaceta No. 40 of February 26, 2009; e) Agreement of the Concejo Municipal of Osa, approved at ordinary session No. 13-2009, chapter IV) Correspondence, item 6), held on January 21, 2009, by which it was resolved to sustain the motion for reconsideration (recurso de revocatoria) and the incidental nullity claim (incidente de nulidad) filed by Empresa Hotelera Dominical S.A., thereby revoking the agreement adopted at item 2) of chapter III of ordinary session No. 32-2008 of August 13, 2008. iii) The substantial nonconformity with the legal order is declared, and as a result, the absolute nullity of the concessions granted to the companies Punta Dominical S.A., Empresa Hotelera Dominical S.A., and Empresa Dieciocho Veintiuno S.A., pertaining to lands located in the restricted zone (zona restringida) of the maritime-terrestrial zone (zona marítimo-terrestre) comprised within the Plan Regulador of Punta Dominical.
The following administrative actions, as well as all related acts and proceedings connected thereto, are accordingly declared absolutely null: a) Agreement of the Concejo Municipal of Osa, adopted at ordinary session No. 07-2004, chapter VI), item 1), held on February 18, 2004, insofar as it approved the draft resolutions submitted by the Municipal Mayor for the granting of concessions and execution of the corresponding contracts in the name of: Empresa Hotelera Dominical S.A., parcel with an area of 3 hectares 7,697.12 square meters; Punta Dominical S.A., parcel with an area of 2 hectares 4,988.21 square meters; Punta Dominical S.A., parcel with an area of 4,886.45 square meters; Punta Dominical S.A., parcel with an area of 13 hectares 6,167.28 square meters; and Empresa Dieciocho Veintiuno S.A., parcel with an area of 9 hectares 6,913.43 square meters; b) The concession contracts signed on March 31, 2004, between the Municipalidad de Osa and Punta Dominical S.A., corresponding to the lands described in the cadastral survey plans (planos catastrados) numbered: P-864164-2003, P-882230-2003, P-883689-2003.
The contract signed on that same date between the Municipalidad de Osa and Empresa Hotelera Dominical S.A., corresponding to cadastral parcel No. P-865511-2003, and the contract signed between the Municipalidad de Osa and Empresa Dieciocho Veintiuno S.A., corresponding to the land with cadastral survey plan No. P-864163-2003, as well as the addendums to said contracts executed on September 20, 2004; b) The resolutions numbered G-2025-2004 and G-2026-2004 of November 18, 2004, as well as the resolutions numbered G-250-2005, G-251-2005, and G-252-2005, the latter dated February 4, 2005, all issued by ICT's General Management (Gerencia), pertaining to the approval of the concession contracts executed between the Municipalidad de Osa and the companies Punta Dominical S.A., Empresa Hotelera Dominical S.A., and Empresa Dieciocho Veintiuno S.A., relating to the lands with cadastral survey plans numbered: P-864164-2003, P-882230-2003, P-883689-2003, P-865511-2003, and P-864163-2003; c) The registration of the following concessions in the Registro Nacional, under registration numbers (matrículas): 1421-Z-000, 1422-Z-000, and 2133-Z-000 of the Partido de Puntarenas; and d) The plans registered in the Cadastre (Catastro) of the Registro Nacional, numbered: P-864164-2003, P-882230-2003, P-883689-2003, P-865511-2003, and P-864163-2003. iv) With respect to the pending concession applications before the Municipalidad de Osa in the name of Punta Dominical S.A., pertaining to lands located in the restricted zone, under cadastral survey plans numbered: P-863801-2003, P-863803-2003, and those corresponding to the concession application being processed under the case file submitted with certification No. 629-2009, it is declared: a) The absolute nullity of the said plans and survey sketches (croquis) supporting those concession applications; b) That the approval of said applications is absolutely inadmissible insofar as those lands encompass areas that form part of the State's Natural Heritage (Patrimonio Natural del Estado) or lie outside the sectors with a tourist designation granted by the Instituto Costarricense de Turismo; c) That the Municipalidad de Osa and the Instituto Costarricense de Turismo are under the unavoidable legal duty to respect the limits and rules established in the legal order with respect to the processing and granting of concessions on lands in the maritime-terrestrial zone comprised within the Plan Regulador of Punta Dominical, including, of course, those set forth throughout this judgment, and shall in particular:
The following is requested by the Contraloría General: 1. That the Municipalidad de Osa, INVU, and ICT be required to report on the actions that have been carried out in compliance with the orders issued by the TCA through substantive ruling No. 11-2019-IV. // 2.- That the joint and several liability (responsabilidad solidaria) of the companies Punta Dominical S.A., Empresa Hotelera Dominical S.A., and Empresa Dieciocho Veintiuno S.A. be declared, as well as that of the counter-defendant public entities — namely the Instituto Costarricense de Turismo, the Instituto Nacional de Vivienda y Urbanismo, and the Municipalidad de Osa — and, consequently, that they be ordered to pay ₡33,755,969.00, the amount corresponding to the environmental damage caused by their actions and/or omissions.-- 3. That, as a precautionary measure (medida de aseguramiento), the immediate cessation of any current or future construction work being carried out in the area of the Restaurant "La Parcela" in Dominicalito de Osa be ordered. And to that end, that SINAC and the Municipalidad de Osa be directed to verify compliance with the Tribunal's orders and to report accordingly. 4. That the bill of attorney's fees (liquidación de costas personales) in favor of the Contraloría General de la República be approved, plus the respective interest until actual payment, in the manner detailed below:
For its part, the Procuraduría requests approval of the award of attorney's fees in favor of the State against Empresa Hotelera Dominical S.A. and Punta Dominical S.A. in the amount of six million colones (₡6,000,000.00), as well as the granting of interest accruing until actual payment, as ordered in judgment No. 11-2019-IV.---
A.- FROM THE EXECUTING PARTY:
During the oral enforcement hearing (audiencia oral de ejecución), the Contraloría ratifies its claims, clarifies matters concerning the defendant companies, and notes that this has been a complex and technical proceeding. In its closing brief to the oral enforcement hearing, it refers to the res judicata (cosa juzgada material) effect of the ruling on the merits and extensively to the expert reports, and finally petitions: 1. That the expert report rendered by court-appointed expert (perito judicial) Eng. Juan Ramón Vargas Arias be dismissed in its entirety, as it flagrantly contradicts res judicata and is based on subjective assessments and personal impressions that negate its technical reliability. // 2. That the economic assessment of the environmental damage presented by the CGR, based on the objective and scientific expert opinion of the State Forestry Administration (Administración Forestal del Estado) (SINAC), be approved in all its aspects, ordering payment of the liquidated and enforceable sum of ₡33,755,969.00. // 3.
That the joint and several liability of all executed private companies and public administrations be declared with respect to payment of the VEDA and the court costs, ordering that the deposit corresponding to the environmental damage be made mandatorily to the SINAC parks fund (fondo de parques) account. // 4. That the liquidation of attorney's fees in favor of the CGR in the amount of ₡11,000,000.00, broken down as set forth in the enforcement brief, be approved, ordering the calculation of applicable statutory interest until actual payment. // 5. That the preventive attachments (embargos preventivos) on the bank accounts of the executed companies be maintained, in order to secure the funds necessary to remedy the ecological damage (daño ecológico) decreed. // 6. That the immediate execution of the definitive eviction (desalojo) and the total demolition of all infrastructure, cabins, and commercial buildings unlawfully erected in the "La Parcela" sector be ordered, expressly providing that such physical demolition is to be carried out by the Municipalidad de Osa, under the technical supervision of SINAC within its area of competence. // 7.
That the Municipalidad de Osa be ordered to immediately transmit to the ICT and INVU all the technical information required to carry out the updating and correction of the Coastal Regulatory Plan (Plan Regulador Costero) of Punta Dominical, with notice of such compliance to be given to the Court.---
B.- FROM THE EXECUTING/LOSING PARTY:
A.- THE PRINCIPLE OF EFFECTIVE JUDICIAL PROTECTION: In accordance with constitutional article 153 and article 1, paragraph 2, of the Ley Orgánica del Poder Judicial, it falls to the Courts to hear the matters assigned to them by the Constitution and the law, to resolve them definitively, and to "execute the rulings they issue" — that is, the full and complete enforcement of the judgments issued by the trial court, when they contain an obligation to do, not to do, or to give, and these are not voluntarily complied with by the obligated party (CPCA, art. 156.3). Enforcement of a judgment is an essential component of the right to effective judicial protection (tutela judicial efectiva) and is indispensable for giving effect to the final and binding ruling, in the terms as set out therein, without alteration or distortion. To that end, the CPCA provides that "During the enforcement phase, the enforcement judge shall have all the powers and duties necessary for its full effectiveness and efficacy" (art. 155.2).
"The judgment must be complied with in the form and terms set out therein" (art. 156.1). "The final judgment of the Court must be enforced immediately (...)" (art. 157). Articles 161(b), 162, 175.1, etc., guarantee the actual satisfaction of the right declared in favor of the prevailing party. "The right to effective judicial protection requires that the judicial ruling be complied with; otherwise, the recognition of rights established therein will be in vain, a mere declaration of intent, causing serious harm to legal certainty. The judgment resulting from the complaint concludes one phase of the proceeding (the cognizance phase), but not the proceeding itself, which continues in a second phase (the enforcement phase) and concludes when the plaintiff's claim has been satisfied." (Sala Primera de la Corte, judgment 348-2016). "It would be unacceptable for a judgment to remain a dead letter and never be brought into reality, nullifying its effects.
For this reason, the judge fulfills a guarantor function and is obligated to ensure full and effective enforcement, both expeditiously and in actuality." (Sala Primera de la Corte, judgments 675-2007, 1443-2012, 122-2016, and 2409-2022).
B.- THE PRINCIPLE OF INVIOLABILITY OF RES JUDICATA DURING THE ENFORCEMENT PHASE: Article 156, paragraph 1, of the Código Procesal Contencioso Administrativo provides that "1) The judgment must be complied with in the form and terms set out therein." In this regard, the Sala Primera de la Corte Suprema de Justicia, by its ruling of 11:45 hours of October 12, 2021, has stated: "V.- On a different matter, regarding the assertion that the lower court did not award the damages and losses sought, it is necessary to recall that this Chamber has ruled: 'The enforcement proceeding seeks to materialize the — abstract — order imposed on the losing party; granting aspects different from — or contrary to — the ruling giving rise to the enforcement, or against persons who were not ordered to pay, violates res judicata (see this Court's ruling No. 001360-F-S1-2017 of 15 hours of November 7, 2017).' Ruling No. 383 of 9 hours 50 minutes of May 9, 2019." Accordingly, both what has been enforced and what is granted at the enforcement stage must correspond to what was declared in the judgment being enforced.
For this reason, in this type of proceeding the aim is to align the individual rule embodied in the enforceable judgment with the factual situation, in order to guarantee the right of the protected party. The purpose, therefore, is to give effect to what was ordered in the condemnatory judgment so as to satisfy the interest of the executing party, insofar as it prevailed in the constitutional forum. Consequently, only claims aimed at giving effect to what was ordered in the condemnatory ruling are admissible in enforcement proceedings. The scope and content of what is ordered in this phase are determined by what was established in the judgment being enforced. The subjective and objective limits of the matter are defined by the enforceable ruling itself, in accordance with its positive and negative effects and the principle of inviolability of res judicata — article 156 of the CPCA. This principle requires that enforcement be carried out on the basis of the terms imposed in the final judgment, thereby limiting the scope of action.
As stated in Considerando III, the adjudicator ruled on the basis of the evidence submitted by the executing party — and therefore, contrary to what is argued, the elements of proof were indeed considered — and the evidence on record bore no causal connection to what was awarded in the enforceable judgment. […] It must be noted that the principle of inviolability of res judicata commands that enforcement be carried out on the basis of the terms imposed in the final judgment, which limits the scope of action — article 156 of the CPCA. Its purpose is to safeguard the integrity of judgments clothed with the authority of res judicata, so that the adjudicator is precluded from permitting any conduct that alters, eliminates, varies, or adds to the content of the ruling obligations not provided for therein, conduct that is sanctioned with nullity. Consequently, no error is found, since the failure to award what the executing party claimed was precisely because it bears no relation to what was granted in the enforced final judgment.
Accordingly, this ground must be rejected."— Therefore, a judgment clothed with the authority of res judicata is immutable, in that it becomes unmodifiable, and coercible, in that it may be forcibly enforced. The party whose right has been declared by judgment "may enforce that ruling without restriction, to the extent of what was resolved, and the judge may not refuse to comply with it" (Tribunal Contencioso Administrativo, ruling 101-2021-VI). On those characteristics of immutability and absolute definitiveness of the declared right, see from the Tribunal Contencioso Administrativo rulings 2006-2002-I, 280-2002-I, 151-2002-II, 130-2008-II, 16-2008-VI; and from the Sala Primera, judgments 740-1999, 481-2000, 680-2002, 1015-2004, 932-2006, and 111-2015.— C.- EXPERT EVIDENCE AND OTHER MEANS OF PROOF: As the doctrine applicable to this subject matter sets forth with respect to expert appraisal (peritaje), it must be assessed that every expert must maintain independence of judgment and the expert opinion (dictamen pericial) must be impartial; in the event a private or judicial expert opinion is rendered, personal ties to the parties or economic interests constitute serious grounds for doubting the expert's sincerity, since what is sought through the guarantee of impartiality is to prevent distortion of the expert's role as a third party in the proceeding, avoiding the possibility that, under certain circumstances, the expert might render an opinion favoring one of the parties.
Furthermore, the purpose of expert evidence is to prove the facts that underpin the parties' claims in the proceeding, with the particular feature that the subject matter of expert evidence consists of facts that are not within the common knowledge of the parties or the judge, so that the expert, through their report or expert opinion, provides the court with the technical knowledge necessary for evaluating the facts in dispute. The minimum necessary degree of scientific and objective impartiality required of the work of examination and rendering of an expert opinion is ensured when the expert acts in accordance with valid and current standards in the relevant discipline and presents them to the judicial body for its assessment. The extensive case law of the Sala Primera on matters related to expert appraisals has stated: "It must be noted that this Chamber has expressed, with regard to the evidentiary value of expert appraisals: (...) that their purpose is to assist the judge with scientific knowledge outside his expertise, but rather than serving as absolute truths that replace his judgment, their objective and scientific content does not limit his power of assessment; they serve only to guide him, providing elements that allow him to evaluate the circumstances essential to the decision to be made.
It is thus clear that departing from a technical opinion, and justifying one's own, far from constituting an excess of authority, is an exercise inherent in the adjudicator's work of weighing the evidence (Resolution No. 43-2007 of 9 hours 10 minutes of January 26, 2007; in the same vein see judgments Nos. 765 of 15 hours 40 minutes of July 24, 2009, and 468 of 10 hours 45 minutes of April 7, 2011). As a matter of principle, it is clear that nothing prevents a judge from departing from an expert opinion, provided that such determination is rationally justified. (...) It should be emphasized that, given the specialized nature of the subject matter proper to technical expert evidence, it is essential that there be counter-evidence of equivalent standing that refutes the expert's conclusions (i.e., that the report has been altered or does not correspond to reality). The burden of proof, pursuant to the mandate of article 317 of the CPC, falls upon whoever asserts a right or a defense; therefore, where there is an expert appraisal quantifying the alleged damages, in order to undermine its evidentiary value it was necessary to submit another evidentiary element demonstrating, conclusively, what the correct calculation is. In accordance with the provisions of paragraph 2 of article 90 of the CPCA, the defendant party had the opportunity to offer evidence to this effect."—
The Contraloría General, in its enforcement brief, presents an analysis of environmental damage, stating that: [...] by means of official communication No. 16662 (DJ-1832) of November 20, 2023, the CGR requested that SINAC "prepare a report identifying and valuing the environmental damage on the lands of the public zone and the restricted zone (zona restringida) of Punta Dominical, as described in ruling No. 11-2019-IV — which is enclosed — a report in which the existence of the environmental damage and its monetary amount must be clearly determined." That in response to the foregoing, on February 12, 2024, Lic. Daniela Valverde Gamboa, Coordinator of the Natural Heritage of the State of the Área de Conservación de Osa of SINAC, issued report No. SINAC-ACOSA-DT-PNE-Inf-006-2024, through which she reported on the field survey (levantamiento de campo) conducted in the area of the "La Parcela" restaurant in Dominicalito de Osa, as stated in that report: "Points are taken with georeferencing (georreferenciación), the dimensions of the infrastructure, roads, parking areas, trails, and related elements are measured. Photographs are taken and a description of the site is made." The information pertaining to the survey of the infrastructure, roads, parking areas, and related elements is summarized in the following table:
The report further states that: [...] in addition to the cabins, roads, and restaurant built in the area, "it was observed during the field inspection that construction work is currently being carried out. The construction of a lookout point at coordinates N 1019727 and E 517176 was observed, along with improvements to the trail leading to the lookout point. Tree felling was even observed at the exact location of the lookout point platform." (Emphasis added.) [...] The constructions and works that have continued to be carried out in the area are clearly visible, in open and flagrant non-compliance with a final judicial judgment and to the detriment of the Natural Heritage of the State. [...] Based on the foregoing field survey, on February 13, 2024, Lic. Valverde Gamboa issued report No. SINAC-ACOSA-DT-PNE-Inf-007-2024, in order to carry out the economic valuation of the serious environmental damage in the area of the "La Parcela" restaurant in Dominicalito de Osa, in connection with which it was stated that: "This area performs very important functions, such as maintaining connectivity between ecosystems, allowing for the continuous movement of wildlife, the establishment of flora, and serving as habitat for various species as part of our PNE, as well as functioning as carbon reservoirs."--- [...].---
Eng. Juan Ramón Vargas Arias renders expert report No. 3235, detailing — in substance — that:
The report states that: [...] Based on the field visit and the corresponding investigation, it is the undersigned's determination that the property has not suffered environmental damage (daño ambiental), given that the impact on soil, water, air, and landscape resources from the works carried out falls within the Low Impact range, with sustainable management for more than 50 years. The following information is attached: 1. Expert opinion detail. // 2. Existing property documents. The report encompasses a visit to the property, as well as a survey of the parcel conducted by the undersigned using GPS, along with consultation of secondary sources including aerial images from Google Earth and other sources, aerial photographs from IGN, and the Dominical cartographic sheet.
The report addresses the methodology employed and notes that: [...] The methodology used consisted of gathering field information, after which a date was set as a starting point for determining whether a negative change in natural resources had occurred in the management of the property from that date onward. In the field, the current land use was defined and the existing infrastructure works were surveyed. In addition, a photographic record of these works was made. The valuation procedure consisted of determining whether the activity that has been carried out—from the date taken as the starting point up to the present—has generated a negative or positive change. A determination was made as to whether harm to resources occurred in a negative sense, from the starting date to the present, with respect to the use prior to that date. As a reference economic value, the value established by the Ministry of Finance known as the Homogeneous Zone Value (Valor de Zonas Homogéneas) was used. A list of assessment variables for the property was established: • Soil • Flora • Air • Water • Fauna • Noise • Scenic beauty • Carbon sequestration.
A weighted value was assigned to each of these variables according to the degree of importance of each variable. The value of the environmental damage was determined from the sum of the weighted effects.
Subsequently, the report contains an introduction, the characteristics of the area, characteristics of the property, of the constructions, [...] Regarding the section on Environment, it states that: [...] Environment: In Article I of ley 7554, "environment" is defined as "the system constituted by the different natural elements that compose it and their interactions and interrelations with human beings." - Environmental Impact (Impacto Ambiental): l) Environmental impact is a change or alteration in the environment, being a cause or an effect due to human activity and intervention or natural causes. This impact may be positive or negative; the negative impact represents a break in the ecological balance, causing serious harm and damage to the environment, as well as to the health of persons and other living beings. Examples include air or ocean pollution from waste or petroleum, noise pollution, wars, and radioactive energy waste, among others. - Environmental Damage: Environmental damage is any action, omission, conduct, or act carried out by a physical or legal person, public or private, that alters, impairs, disrupts, diminishes, or places in imminent and significant danger any constitutive element of the concept of environment, thereby breaking the natural equilibrium of ecosystems.
Article 98 of ley No 7554 states that: "Damage or contamination of the environment may result from acts of commission or omission and is attributable to all physical or legal persons who carry them out," and cites other legal and regulatory provisions. This report also notes: - Situation Found or Present on the Property: The current use of the property is an orchard (huerto) composed of cultivated mango trees, bamboo, coconut palms, and ornamental plants, with a low-density tourism accommodation project, restaurant, trail, and lookout point. 1) Buildings: The following buildings are located on the site:
The report continues: [...] 2) Current use of the farm. The parcel has a plant cover (cobertura) consisting of the cultivation of introduced species and established native species that together constitute a current use as an orchard, which was promoted after the natural vegetation was removed. The evidence indicates that this plant association has been present on the site for many years; the most evident example is the mango trees, which, in addition to being a non-native species, are planted in a linear geometric arrangement characteristic of a deliberate planting (see figure 20) and currently stand at heights greater than 20 meters with diameters of up to 145 cm DBH (D.A.P., Diámetro a la altura de pecho). See figure 21. According to a technical note² on mango, "Mature trees typically grow to a height of 25 m or more, with main trunks of up to 15 m and diameters at breast height (D.A.P.) of between 0.6 and 2.0 m."
In the present proceedings, judgment No. 11-2019-IV issued at 08:15 hours on February 25, 2019, by Section IV of the Contentious-Administrative Tribunal (Tribunal Contencioso Administrativo), is being enforced—which in its essential part ordered: "Por tanto (...) (SEE ANNULMENT PROVISIONS points i) through x))." In this same vein, the judgment in question establishes a series of COMPENSATORY CONDEMNATIONS AND/OR REPARATIONS, as detailed below: "[...] xi) The companies Punta Dominical S.A., Empresa Hotelera Dominical S.A., and Empresa Dieciocho Veintiuno S.A. are condemned, in the abstract, to pay damages and losses caused to the environment and to the State Natural Heritage (Patrimonio Natural del Estado), by virtue of their unlawful actions in relation to the lands of the maritime-terrestrial zone (zona marítimo-terrestre) of Punta Dominical, the existence and amount of which shall be established in the enforcement of judgment (ejecución de sentencia) phase. xii) The counter-defendant (contrademandadas) Administrations are condemned, in the abstract, to pay damages and losses arising from active or omissive administrative conduct that has caused harm to the State Natural Heritage and to the environment on the lands subject to these proceedings, the existence and amount of which shall be established in the enforcement of judgment phase. xiii) The counter-defendant Administrations are declared liable for the unlawful omission in the timely and adequate exercise of the powers conferred upon them by the legal framework, to achieve the revocation or annulment of the administrative conduct subject to these proceedings and the effective protection of the maritime-terrestrial zone lands involved in this litigation. xiv) The counter-defendant companies and Administrations are ordered to refrain from engaging in active or omissive conduct that causes harm to the State Natural Heritage and the environment on the maritime-terrestrial zone lands encompassed within the Coastal Regulatory Plan (Plan Regulador Costero) of Punta Dominical. xv) With respect to the claim, Empresa Hotelera Dominical S.A. and Punta Dominical S.A. are condemned to pay full court costs (ambas costas), in favor of the State, the Contraloría General de la República, and SINAC, together with the respective legal interest, to be computed from the date the resolution determining their quantum becomes final until actual payment.
With respect to the counterclaim (contrademanda), Empresa Hotelera Dominical S.A., Punta Dominical S.A., Dieciocho Veintiuno S.A., Municipalidad de Osa, INVU, and ICT are condemned to pay full court costs in favor of the Contraloría General de la República, together with the respective legal interest, to be computed from the date the resolution determining their quantum becomes final until actual payment." In this regard, the following items are deemed acknowledged: A.- Payment of damages and losses caused to the environment and to the State Natural Heritage. B.- Payment of damages and losses arising from active or omissive administrative conduct that has caused harm to the State Natural Heritage and to the environment on the lands subject to these proceedings, the existence and amount of which shall be established in the enforcement of judgment phase. C.- The counter-defendant companies and Administrations are ordered to refrain from engaging in active or omissive conduct that causes harm to the State Natural Heritage and the environment on the maritime-terrestrial zone lands encompassed within the Coastal Regulatory Plan of Punta Dominical.
D.- With respect to the claim, Empresa Hotelera Dominical S.A. and Punta Dominical S.A. are condemned to pay full court costs in favor of the State, the Contraloría General de la República, and SINAC, together with the respective legal interest, to be computed from the date the resolution determining their quantum becomes final until actual payment. E.- With respect to the counterclaim, Empresa Hotelera Dominical S.A., Punta Dominical S.A., Dieciocho Veintiuno S.A., Municipalidad de Osa, INVU, and ICT are condemned to pay full court costs in favor of the Contraloría General de la República, together with the respective legal interest, to be computed from the date the resolution determining their quantum becomes final until actual payment.
In this regard, the Contraloría General de la República requests in its initial enforcement brief as follows: 1. Require the Municipalidad de Osa, INVU, and ICT to report on the actions that have been executed in compliance with the order issued by the TCA in substantive resolution No. 11-2019-IV. // 2.- That the joint and several liability (responsabilidad solidaria) of Punta Dominical S.A., Empresa Hotelera Dominical S.A., Empresa Dieciocho Veintiuno S.A., and the counter-defendant public entities—namely the Instituto Costarricense de Turismo, the Instituto Nacional de Vivienda y Urbanismo, and the Municipalidad de Osa—be declared, and consequently that payment of ¢33.755.969,00 be ordered, an amount corresponding to the environmental damage generated as a result of their actions and/or omissions. 3. That as an enforcement security measure (medida de aseguramiento), the immediate suspension of any current or future construction work being carried out in the area of the "La Parcela" Restaurant in Dominicalito de Osa be ordered. To that end, SINAC and the Municipalidad de Osa be directed to verify compliance with the Tribunal's order and to report accordingly. 4. That the settlement of personal court costs (costas personales) in favor of the Contraloría General de la República be approved, plus the respective interest until actual payment, in the manner detailed below:
Subsequently, in the written closing arguments, the party reaffirms the claim to approve the assessments for environmental damage (daño ambiental), the declaration of joint and several liability (responsabilidad solidaria), the award of costs plus statutory interest, the continuation of precautionary attachments (embargos preventivos), the precautionary-measure petition, and the eviction-prevention motion, as well as the request that the Municipality of Osa immediately transmit to ICT and INVU all technical information required to bring about the update and correction of the Coastal Regulatory Plan (Plan Regulador Costero) of Punta Dominical.
For its part, the Procuraduría requests approval of the award of attorney's fees in favor of the State against Empresa Hotelera Dominical S.A. and Punta Dominical S.A. in the amount of six million colones (₵6,000,000.00), as well as the granting of interest accruing until actual payment, as ordered in judgment No. 11-2019-IV.
And in the written closing arguments, the Procuraduría reaffirms that claim and adds a request that the parties be immediately ordered to vacate and that ACOSA be commissioned to verify compliance, with the assistance of the Fuerza Pública if necessary, recalling that Articles 156 and 157 of Ley 8508 vest the enforcement judge with the powers necessary for the full effectiveness and enforceability of what was ordered in the judgment.
The court proceeds to analyze each of the issues:
A.- ENVIRONMENTAL DAMAGE:
● It is established that for the vegetation resource, the economic value is ₵17,290,025.60, which includes the value of the cost of the eliminated forest, carbon, and oxygen. ● As for the estimate of the loss of scenic value (valor paisajístico), an economic loss of ₵7,627,963.05 is estimated. This is a high value, given that it is an area declared as State Natural Heritage (Patrimonio Natural del Estado), areas that should be dedicated to the protection of natural resources. ● For administrative expenses, a value of ₵212,698.64 was obtained, accounting for the work carried out in both the preliminary field survey describing the damage found, the follow-up to the case, the preparation of the VEDA, and the quantification of the participation of all SINAC-ACOSA staff who handled the case.
Thus, said report established that the estimate of the economic valuation of environmental damage caused in the area of Restaurant "La Parcela" in Dominicalito de Osa amounts to ₵25,130,914.29, a sum that was adjusted on February 27, 2024, through report No. SINAC-ACOSA-DT-PNE-Inf-008-2024, prepared by Licda. Valverde Gamboa, stating: "Due to a material error in report SINAC-ACOSA-DT-PNE-Inf-007-2024, the costs for demolition and site restoration were not included within the damage valuation," which were specified as follows:
● It is established that for the cost of demolition of the works, the economic value is ₵2,772,077.00. An estimate is made of how much it could cost to demolish the constructed works, generating activities such as hiring labor, transporting materials, renting machinery, and contracting an engineer to supervise the project. ● As for the estimate of the site restoration cost, a value of ₵5,852,978.00 is estimated, quantifying costs for the purchase of forest trees, transport, site preparation and tree planting (clearing, layout, marking, hole-digging, and planting), maintenance, monitoring and protection, and professional forestry oversight (regencia mediante un ingeniero forestal).
The total estimated for these two new indicators is ₵8,625,055. Accordingly, the TOTAL ESTIMATED VALUE corresponding to the economic valuation of environmental damage (VEDA) in the area of "La Parcela" in Dominicalito de Osa is ₵33,755,969.00, [...]".
During the oral enforcement hearing, said witness/expert was examined and responded — in substance — to questions from the Contraloría: that she holds a degree in forest engineering, that she works in the Protected Wildlife Areas Division, and that she worked in the State Natural Heritage Department. Regarding the actions taken, she states that she analyzed the judgment, worked with the State Natural Heritage Department to access the case file, that she carried out a field visit together with a surveying official, that she performed office work, and that she produced the report. She states that the area coincides with Map B1, is located by georeferenced coordinates, that physical elements were found; she identifies Restaurant La Parcela, a parking area with a stone-paved surface, four cabins, a laundry area, totaling nine constructed features. She refers to the images contained at page 249 of the file, relating to trees with leaves and branches and recent works, where stumps (tocones) — the remaining trunk bases — from tree felling are evident.
She describes the instruments used, addresses the four types of official methodologies used by SINAC for its studies, which have been validated by experts such as the Instituto de Políticas Sostenibles as well as the Alfredo Zeledón method. She explains the indicators such as carbon, oxygen, scenic value, and restoration costs (demolition costs). She notes that at the site there are mango trees that may be part of the ecosystem.
On the other hand, in response to questions from SINAC, she states that what was requested was an environmental damage valuation; she used the Alfredo Zeledón method to quantify the environmental damage in the forest component, plus the Instituto [de Políticas para la Sostenibilidad] method for the restoration matrix. She clarifies that it is not possible to estimate environmental damage without a methodology, in order to evaluate technique and science based on expert criteria, bibliography, and other sources. That she used variables derived from the methodology, such as affected area and affected elements, with images that must be georeferenced and whose sources must be reliable, requiring in-situ spatial analysis using sources from IGN that allow for regression, as well as SINAC sources on forest cover (cobertura forestal). She notes that images taken from Google Maps are secondary sources that lack precision.
She addresses the procedure for determining an area declared as forest under the provisions of the Ley Forestal, which meets the technical parameters in accordance with the methodology designed by the Universidad Nacional, with quantitative and qualitative forest analysis; this must be carried out through sampling plots (parcelas de muestreo), establishing the number of trees, height, canopy cover, different species, and quantity per hectare. She states that establishing sampling plots is office work, and that one cannot reach a conclusion of forest without conducting sampling plots.
Regarding questions from the Procuraduría, she addresses Report 6, image 3(d), on the parking area, the number of parked vehicles, and its purpose as parking for tourist vehicles going to the restaurant. She addresses the 2,900 m² area as the delimited polygon, stating that the distance between the cabins and the restaurant places them within the forest, that the mango trees are in a line, that she cannot specify the exact number of trees, that they could represent approximately 15%, and she explains Map 1(d) from image 210 of the file and the different zones therein. She concludes by stating that the norm authorizing these studies derives from SINAC's competencies, grounded in veracity and ethics, with the use of authorized and competent sources.
On the other hand, in response to questions from ICT, she indicates that there are recent works, since persons are identified working at the site with materials such as stone and posts; a structure that appears unfinished is visible, with construction that may be months old; that those works postdate the 2019 judgment; that she did not include them within the damage assessment and did not quantify them; and that what she did was report them to the Contraloría.
Regarding questions from the Municipality of Osa, she responded that in order to determine an ecosystem as forest it is necessary to conduct sampling plots, that these were done in the ACOSA 2008 report, that no forest species inventory was conducted for this report, that the 2008 report was used as the starting point — which has been generating [results] — and that in this case it was not necessary to conduct one because it is an already-impacted area. She insists that there are constructions dating back several years, that she cannot specify exactly how long ago they were built, but that she can confirm an encroachment. That Map 1 was produced by the surveyor and that Google Maps was also used, and that regarding the mango trees she has no data but that they could be over 50 years old.
Regarding questions from the representative of the plaintiff/losing companies, she responds that her superior is the Director of the Osa Wildlife Area, that when she produced the report she was assigned to the State Natural Heritage Area, that she studied forest economics as part of her degree coursework, and that she has received additional training. When asked why she did not report the alleged recent works, she stated that an account was rendered to the Contraloría General, that she does not know whether the works are repairs or improvements, and that she estimates that the trees cut down numbered between 3 and 4. She details the methodology for calculating damage and restoration, which is not based on the number of trees cut down but is obtained by estimating from neighboring sampling plots the quantity of biomass they generate, which is converted into carbon/oxygen, as well as the scenic value, areas of tourist value, and the quantification of scenic beauty — aspects addressed in report SINAC-ACOSA-DT-PNE-007-2024.
The counterclaimant/enforcement parties, in their written closing arguments, stated the following: on the one hand, the Contraloría noted that, regarding the Economic Valuation of Environmental Damage (VEDA), it expressly requests that full evidentiary weight be granted to the sequence of technical reports incorporated into the enforcement file — reports SINAC-ACOSA-DT-PNE-006-[007]-[008]-2024 and CARTA-SINAC-ACOSA-DT-124-2025. It notes that SINAC, in its capacity as a specialized agency of MINAE, is vested by explicit legal mandate with the status of State Forestry Administration, being the technically and legally empowered authority to act as the official expert evaluator in proceedings for the quantification of damages against public natural resources, as derived from Art. 58 of Ley Forestal No. 7575. It states that the reports rendered by said technical authority in this field do not constitute subjective opinions, but rather enjoy two fundamental qualities: 1) technical objectivity, and 2) the completeness and exhaustiveness of the field findings; that in preparing its report it used scientific methodologies, namely the guidelines of the Instituto de Políticas para la Sostenibilidad and the technical-environmental directives of official communication No. SINAC-DE-2024-2021 — that is, objective parameters with legal and scientific backing that are applicable precisely to this type of economic valuation.
It further states that SINAC officials conducted a precision physical field survey (levantamiento físico de precisión) on January 26, 2024, using Spectra Geospatial SP85 GNSS receivers and Garmin GPS units, determining a consolidated and homogeneous constructive impact footprint of 2,970 m². This study was not limited to measuring static infrastructure but documented, through a rigorous photographic archive, contemporaneous and flagrant physical alterations, such as the recent felling of trees, the removal of native vegetation for the unauthorized construction of a new lookout point at georeferenced coordinates N 1019727 and E 517176, and unauthorized modifications to the footpaths. It also attaches the definitive expert breakdown structured in Report No. SINAC-ACOSA-DT-PNE-Inf-008-2024, which specified the essential material line items for demolition and biophysical restoration, yielding the quantum of environmental damage.
In this vein, SINAC, for its part, stated the following regarding the Use of Scientific and Official Methodologies versus Subjective Criteria ("Own Sources"): The most critical aspect of an Economic Valuation of Environmental Damage (VEDA) is the method used to reach its conclusions, given that Ing. Daniela grounded her expert assessment (peritaje) in scientific and official methodologies, specifically the Alfredo Zeledón methodology and the Methodology for the Economic Valuation of Environmental Damage of the Instituto Políticas para la Sostenibilidad (IPS), officially adopted through official communication SINAC-DE-2024-2021. This guarantees a proven and accepted procedure for quantifying the loss of ecosystems, carbon sequestration (fijación de carbono), oxygen, and scenic value, as Ing. Valverde explained at length, whereas, by contrast, [...].
On Technical Precision and Georeferencing versus Non-Official Images without Symbology: SINAC notes that georeferencing is fundamental in an environmental damage study because it allows for the technical location and delimitation of the affected area; that Ing. Valverde identified the areas through georeferencing and fieldwork that included a survey of the infrastructure and its geospatial location; but that the photographic roll submitted by Vargas lacks coordinates and symbology, to the point that, when questioned at the hearing, he was unable to specify the exact location of the constructions he was pointing to, and since the images lack georeferencing it is also impossible to be certain that they are images belonging to the affected site. [...] Consequently, not only is there a notable absence of the application of objective scientific and technical methodologies, but also an incomplete assessment of the available documentary background, a circumstance that inevitably compromises the soundness and reliability of the conclusions reached by the expert.
It notes that the certification issued by SINAC in 2008 did not constitute the creation of the State Natural Heritage status of the property in question, but rather the administrative recognition of a pre-existing legal reality, grounded both in applicable forestry legislation and in the historical continuity of the protection regime that, since the first forestry laws of the Republic (enacted in 1969), has applied to forested lands belonging to the State.
In the opposite direction, the counterdefendant/losing parties challenged — through the companies' representative — the claimed damages and losses: expressing their opposition to the environmental damage valuation reports prepared by SINAC, on the grounds that SINAC is a party with interests in this proceeding and that the reports lack the minimum essential elements for establishing a damage; as well as their opposition to the references to illegal constructions or additions to existing structures, which they find entirely removed from reality, arguing that the reports make no reference to the prior condition of the buildings so as to enable a sound comparative basis from which to conclude that new works were constructed; they challenge the statements made regarding an alleged tree felling, which yield an estimate of several million colones as a result of that unfounded reference to felling. They note that there is a conspicuous absence of even a general description of the characteristics of that damage, as required under Article 196 of the Ley General de la Administración Pública.
Given the challenges to the SINAC report — to the effect that the SINAC reports correspond to a field survey in which SINAC officials measured cabins, footpaths, roads, the parking area, laundry area, entrance, and restaurant, concluding that a total affected area of 2,970 m² exists and that the land has been subjected to land-use change (cambio de uso del suelo), shifting from forest to areas occupied for tourist use — the counterdefendants note: However, that document measures occupied surfaces but does not sufficiently demonstrate the causal link between each of those spaces and a recent, current, and legally attributable environmental damage within the relevant time frame for this enforcement proceeding. It does not adequately differentiate which works are old, which are recent, and which pre-existed as of the relevant base date. They note that report 007-2024 sets an economic valuation of environmental damage at 25,130,914.29 colones, integrating line items for eliminated forest, carbon, oxygen, scenic value, and administrative expenses.
The central objection is that this quantification rests on assumptions not sufficiently demonstrated in the underlying report. They also note that the methodology used — based on the Alfredo Zeledón methodology as adapted by SINAC — operates in this specific case as an abstract valuation system that does not ultimately align with the specific historical and biophysical reality of the site. The report uses heterogeneous indicators and sources across time, including oxygen prices from 2010, carbon references from other literature, and ecosystem values drawn from general studies, without adequately justifying their specific relevance to Dominicalito. There is also a problem of improper homogenization of the affected area: the report treats practically all 2,970 m² as if they constituted a uniform block of eliminated forest, despite the fact that at the site there coexist constructed components, parking areas, footpaths, and the presence of introduced and native species, as well as specific recent interventions and old structures.
Finally, it argued that, having been issued by a party with a direct interest in the outcome of this proceeding and with its own claims, it requests that the evidentiary efficacy of reports SINAC-ACOSA-DT-PNE-Inf-006-2024, SINAC-ACOSA-DT-PNE-Inf-007-2024, and SINAC-ACOSA-DT-PNE-Inf-008-2024 be rejected on account of their methodological deficiencies.
During the oral enforcement hearing, said court-appointed expert was examined and responded — in substance — to questions from the companies' representative: that the area is 2,900 m², with century-old mango trees, which are exotic non-native trees; that no forest was found but rather an orchard; that a cartographic image from 1976 was verified; that there is no environmental damage; that there is a balance among the resources; and that there are no recent constructions, since the constructions have wooden planks that have been in use for years.
In response to questions from the Municipality, he states that for more than 50 years a restaurant has already existed there; that there are no negative changes in the resources; regarding the reliability of the photographs, he states that various tools are used and that they are now satellite-based; he also states that the mango trees are old given that they are in a row and given their dimensions, verified during a field visit; and he states that he does not know whether the natural vegetation was eliminated, affirming that the current vegetation sequesters carbon and contributes to the flora and fauna ecosystem.
On the other hand, in response to questions from the Contraloría, he states that he was not provided with all the documents in the case file; that he did read the judgment; that the existing vegetation resulted from a land-use change that occurred many years ago, through human intervention. Regarding the pergola (image contained in the report), he states that it is on a footpath, that he does not recall its base, that it is not very old, that it has materials from between 15 and 20 years ago, and that no tree felling is visible.
In response to questions from the State representative, he indicates that he did have access to the enforcement file. Regarding questions from SINAC, he responds that data collection took place on August 19, 2025, and that the report is dated October 15, 2025; that he has 40 years of experience; that he served as Regional Director of Huetar at MINAE; that he is a private consultant and court-appointed expert with 20 years of experience; and that he is a forest engineer specializing in damage valuation. When asked about the methodology used, he refers to in-situ visits, cartographic maps, and photographs; states that there is no single methodology; that he took the property value, mentions the methodologies, and refers to his own-source methodology, whereby the utility is obtained by taking the land value and dividing it among flora, fauna, scenic beauty, and carbon sequestration. He states that as sources for the procedure he takes the environmental elements present at the site — vegetation, soil, fauna — which represent an appraisal by the expert as a specialist, while other sources are literary, documentary information, internet sources, and photo-interpretation.
Regarding the photographs, he states that the site is georeferenced, that the images are loaded onto a satellite platform, that certain construction points are identified, and that they can be seen by coordinates. Finally, he states that he did not establish sampling plots and that no forest is visible; that the site has components including mango trees, sea on both sides, vegetation, scenic beauty, and ecotourism activity.
In the written closing arguments, the companies' representative, ICT, and the Municipality of Osa all expressed their views. The companies' representative stated that, regarding the Report of Expert Vargas Arias, it offers a comparatively more consistent methodology for answering the central question of this enforcement proceeding: whether a current and attributable negative environmental change actually occurred on the property. The expert assessment is based on a field visit, GPS survey, photographic record, consultation of historical Google Earth images, aerial photographs, and the Dominical cartographic sheet, and establishes a temporal baseline approach to compare the prior and current use of the property. That approach is methodologically more appropriate than simply assuming, without further refinement, that the mere current occupation of the land is equivalent to compensable environmental damage; therefore, the report prepared by the court-appointed valuation expert designated by this Court, who rendered the required economic valuation in accordance with the principles of objectivity and impartiality, must be given consideration.
For its part, ICT states that greater persuasive weight should be given to the methodological approach in the expert report of Juan Ramón Vargas Arias, particularly as regards the temporal baseline, historical evidence, chronology of structures, and comparative analysis of land use and possible negative environmental change. // 5. Reject the claim for a declaration of joint and several liability among the counterdefendant agencies for purposes of payment of damages, as this was not ordered in the judgment being enforced.
On the other hand, the Municipality of Osa states that [...] on the analysis of the expert evidence — in substance — that the expert evidence has already been heard, that the expert Juan Ramón Vargas Arias was interviewed at the hearing on June 3, 2026, and reiterates that, in accordance with said expert assessment, THERE IS NO ENVIRONMENTAL DAMAGE WHATSOEVER. It further states that THERE ARE NO TECHNICAL OR METHODOLOGICAL DEFICIENCIES in the expert assessment rendered by Engineer Juan Ramón Vargas Arias as the expert appointed by the Court. In that regard, it points out that: a) Both experts were familiar with the methodology known as "Métodos de Valoración Económica para la Cuantificación del Daño Ambiental para el Recurso Agua, Suelo, Bosques y Arboles Individuales de Alfredo Zeledón. 2012." b) Both expert assessments also used the same technological tool. The Expert Report and the statements made during the hearing by Expert Engineer Juan Ramón Vargas Arias expressly indicate that he used the Google Earth tool.
Finally, regarding the claims contained in the Enforcement of Judgment brief filed by the Contraloría General de la República on April 1, 2024: c) Expert Engineer Juan Ramón Vargas Arias states with precision that THE AREA OF THE CONSTRUCTIONS ALREADY EXISTED SINCE THE FIRST CARTOGRAPHIC SURVEY (Dominical Cartographic Sheet) conducted by IGN of the area in the years 1956, 1957, and 1975. In those same orthophotographs by IGN, THE EXISTENCE OF THE CONSTRUCTIONS (RESTAURANT AND CABINS) IS VISIBLE.
In contrast, the Contraloría, SINAC, and the State expressed their views in their written closing arguments in a manner adverse to the report. SINAC stated: Regarding the report of Expert Vargas Arias: It indicates that the opinion rendered by the court-appointed expert, Ing. Juan Ramón Vargas Arias — in which he purports to fix, in an astounding manner, the amount of environmental damage at zero colones (under the fallacious argument that the construction works are of "Low Impact" and that the site has operated as a "sustainable orchard" for more than 50 years) — must be flatly rejected and comprehensively dismissed for the following legal reasons:
● Direct and frontal violation of res judicata (cosa juzgada material): To casually assert that there is no environmental damage susceptible to valuation is to openly disregard the Por Tanto of final judgment No. 11-2019-IV, which has already condemned the parties being enforced against, precisely, for having caused damage to the environment and to the State Natural Heritage (PNE) — a matter that is therefore not open to discussion.
● Explicit confession of ecological damage in the expert report: Paradoxically, on page 14 of his report, Ing. Vargas Arias expressly acknowledges that: "The property has a cover consisting of the cultivation of introduced species and native species that have been established, forming a current orchard land use, which was promoted after the natural vegetation was eliminated." ● Complete lack of rigor and procedural disconnect: During the proceedings in this phase, it was fully established that the court-appointed expert did not have access to the case file nor did he review the final judgment issued by the Administrative Court.
● Lack of scientific objectivity due to subjective elements: The expert report lacks the impartiality and neutrality required by the Código Procesal Civil. Ing.
Vargas Arias incorporated assessments of a strictly personal nature into his analysis, demonstrating that his conclusion of "zero damage" reflects an emotional attachment to the continued operation of the commercial establishment rather than a scientific-ecological examination of the loss of environmental services (servicios ambientales) in a state forest (bosque estatal).
--- For its part, the State argued with respect to the scope of the technical reports and the field sheets submitted by Eng. Vargas Arias. It contends that the report by Eng. Vargas Arias lacks objectivity and truthfulness insofar as it concludes that the damage is zero. Not only because it ignores the validity and technical rigor of existing official methodologies for the valuation of environmental damage (daño ambiental): the "Metodología para la Evaluación Económica de Daños Ambientales" of the Instituto de Políticas para la Sostenibilidad (Institute for Sustainability Policy), the "Métodos de Valoración Económica para la Cuantificación del Daño Ambiental para el Recurso Agua, Suelo, Bosques y Árboles Individuales" by Alfredo Zeledón, and the "Metodología Adaptada y Mejorada por la Comisión de Valoración Económica del Daño Ambiental del SINAC," made official by office communication SINAC-DE-2024-2021; but also because Eng.
Vargas Arias acknowledged in his testimony of June 3rd of this year that he had not studied the principal case file (legajo de conocimiento) containing the final judgments (sentencias firmes) 11-2019-IV and 861-F-S1-2023, further noting that he is a native of the area and had previously visited the questioned facilities to enjoy their goods and services in a social capacity — circumstances that strip his submission of any value or utility. The State argues that the technical reports SINACACOSA-DT-PNE-Inf007-2024 and SINAC-ACOSA-DT-PNEInf-008-2024, based on Natural Heritage of the State (Patrimonio Natural del Estado, PNE) classifications from 2009, and in light of that pre-existing condition established by Article 13 of Ley 7575 and its predecessors (Leyes 4465/1969, Articles 18, 19, and 28; 7174/1990, Articles 32, 33, and 35), technically and scientifically evaluate the damages caused by the construction of cabins, a restaurant, a lookout point, a parking area, trails, and other structures that altered essential ecological processes of natural regeneration, infiltration, water retention, and soil stability, along with the loss of environmental services (oxygen and carbon, the value of the eliminated forest, and scenic value), plus administrative expenses related to demolition and restoration of the site.
The State also adds that: It is immaterial, as the counterparties assert, that some of the constructions are 40 or 50 years old. Regardless of that fact, as Eng. Vargas Arias himself acknowledges, they are located in the public zone (zona pública), subject to common use since Ley 162 of June 28, 1828; that the image used in the examination on June 3rd last is illustrative — sea, coast, and cliffs to the north and south; inland, to the east and west, forest and anthropogenic impacts (afectaciones antrópicas) shown in blue, light blue, and white, with consented and permitted use based on the now-annulled acts issued by the defendant institutions.
---- For its part, SINAC noted that, with regard to the use of scientific and official methodologies versus subjective criteria ("own sources"): The most critical aspect of an Economic Valuation of Environmental Damage (Valoración Económica de Daño Ambiental, VEDA) is the method used to reach conclusions, [...] whereas, by contrast, expert Vargas Arias admitted basing himself on an "own source" to assign weighting values to environmental damage, arriving at the absurd conclusion that the damage is "zero" and of "low impact." He also explained that his report was based on subjective aspects drawn from his own experience; when this representative asked him whether he was aware of any scientific method or methodology applicable in such cases, he stated that none existed, only to contradict himself throughout the examination and ultimately acknowledge the existence of the Zeledón methodology, once again confirming the science and technique applied by Eng. Evelin Valverde. Eng. Vargas applied no recognized scientific methodology; he merely set an arbitrary starting date from which to measure a supposed "negative change," issuing a reckless opinion lacking any technical basis.
-- With regard to technical precision and georeferencing (georeferenciación) versus unofficial images with no symbology: SINAC notes that georeferencing is fundamental to an environmental damage study because it allows for the technical location and delimitation of the affected area; that Eng. Valverde identified the areas through georeferencing and field work that included a survey of the infrastructure and its geospatial location; however, the set of photographs submitted by Vargas lacks coordinates and symbology, to the point that, when examined at the hearing, he was unable to specify the exact location of the constructions he was pointing to, and since the images lack georeferencing, there is no certainty that they even pertain to the affected site.
With regard to legality and res judicata (cosa juzgada): The expert appraisal (peritaje) by Eng. Vargas Arias flagrantly disregarded the legal reality of the property by asserting that it "is not forest" and does not correspond to the PNE because it had allegedly been used as an "orchard" for more than 50 years. This assertion constitutes contempt for the final judgments (N.° 11-2019-IV and 861-F-S1-2023) that had already recognized the validity of SINAC's classifications, declared the occupation illegitimate, and ordered the payment of environmental damages to the PNE. The forest and PNE designation is not open to debate, as the area has held official SINAC certifications since 2008. The expert Vargas attempted to reopen a debate that has already become res judicata, disregarding the scope of his appointment — and not only that, but he did so subjectively, as he himself acknowledged; when this representative asked him whether he had established sample plots in order to reach that conclusion, he confirmed that he had not, whereas the absolute necessity of establishing such plots had been explained by Eng.
Valverde as an absolutely essential element for reaching such a conclusion. Furthermore, during his testimony the expert repeatedly contradicted himself regarding the sources of information used to prepare his report. Consequently, there is not only an absence of objective scientific and technical methodologies, but also an incomplete assessment of the available documentary background — a circumstance that inevitably undermines the soundness and reliability of the conclusions reached by the expert.
--- The Tribunal's Opinion. This adjudicator finds, with respect to the judicial expert appraisal by Eng. Vargas Arias, that upon analyzing said report and having received the expert evidence at the oral enforcement hearing (audiencia oral de ejecución), the following observations are reached: the court-appointed expert (perito) Eng. Vargas Arias does not clearly, precisely, or convincingly demonstrate that he studied the complete case file (expediente) in the main folder of this matter; he reviewed only the enforcement file (legajo de ejecución), so his conclusion that no damage exists openly contradicts what the Trial Court determined, generating a violation of the principle of res judicata and of the right to effective judicial protection (tutela judicial efectiva), since his mandate was to submit an expert report. In this regard, as established by the rules of science and professional practice, as well as the applicable legal and jurisprudential provisions, in order to conduct an expert appraisal the professional must analyze all relevant background information, review the case files — that is, conduct a desk review (trabajo de gabinete) — and not merely limit himself to a field visit or in situ inspection, in order to quantify and identify the scope of the substantive ruling, in this case the existence of environmental damage.
Accordingly, his conclusion is contrary to the substance of what was decided, insofar as he asserts that the monetary amount of environmental damage is zero colones, on the grounds that the construction works are of "Low Impact" and that the site has operated as a "sustainable orchard (huerto sostenible)" for more than 50 years — an assertion that manifestly contradicts logic, science, and professional practice, given that his own report acknowledges the existence of a restaurant, cabins, and other constructions, all of which he knew about previously because he is a local resident of the area.
--- Furthermore, and as stated above, such an assertion constitutes a direct and frontal violation of res judicata, and implies openly disregarding final judgment N.° 11-2019-IV, which ordered the defendant parties to pay damages in the abstract for having caused harm to the environment and to the Natural Heritage of the State — a matter that is not subject to debate, is foreclosed, and is final. It is also found that the expert made clear, with respect to the types of methodology applicable to the determination of environmental damage, that he used his own method; while as an expert he may generate professional opinions governed by the rules of his own knowledge and understanding, the truth is that in the face of any appearance of subjectivity, the expert is required to demonstrate and certify a series of steps, procedures, tools, and methods generally recognized and/or approved by peer experts, in order to guarantee the objectivity of his work — an aspect that, given his own statements, is called into question, having admitted the use of a self-sourced methodology, with reasonable doubts further established regarding the georeferencing of the photographs used, the determination of forest cover (cobertura de bosque), and the designation of sustainable orchard, all without making rigorous technical reference to the official methodologies for the valuation of environmental damage: the "Metodología para la Evaluación Económica de Daños Ambientales" of the Instituto de Políticas para la Sostenibilidad, the "Métodos de Valoración Económica para la Cuantificación del Daño Ambiental para el Recurso Agua, Suelo, Bosques y Árboles Individuales" by Alfredo Zeledón, and the "Metodología Adaptada y Mejorada por la Comisión de Valoración Económica del Daño Ambiental del SINAC," made official by office communication SINAC-DE-2024-2021.
Consequently, the expert report lacks the impartiality and neutrality required by the Código Procesal Civil, applied as a supplementary rule (norma supletoria) to the CPCA, and is therefore disregarded as having no value or utility in this case.
-- On the other hand, with respect to the technical reports SINACACOSA-DT-PNE-Inf006-2024, SINACACOSA-DT-PNE-Inf007-2024, and SINAC-ACOSA-DT-PNEInf-008-2024, submitted on the basis of PNE classifications from 2009, grounded in the applicable legal framework — specifically Article 13 of Ley 7575 and its predecessors (Leyes 4465/1969, Articles 18, 19, and 28; 7174/1990, Articles 32, 33, and 35) — and having heard the testimony of witness/expert Eng. Valverde, these reports technically and scientifically evaluate the damages caused by the construction of cabins, a restaurant, a lookout point, a parking area, trails, and other structures that altered essential ecological processes of natural regeneration, infiltration, water retention, and soil stability, along with the loss of environmental services (oxygen and carbon, the value of the eliminated forest, and scenic value), plus administrative expenses related to demolition and restoration of the site.
It is necessary to note that although the plaintiff/counterclaimed/defeated parties insisted that some of the constructions are 40 or 50 years old, what was established by the judgment on the merits, and confirmed in the aforementioned reports as well as in the testimony of the witness/expert, is that they are located in the public zone, subject to common use since Ley 162 of June 28, 1828; that the photographic evidence, maps, and images used unambiguously illustrate the existence of sea, coast, and cliffs to the north and south, as well as land, to the east and west, forest and anthropogenic impacts in blue, light blue, and white, with consented and permitted use under the now-annulled acts issued by the defendant institutions, as shown below:
It is appropriate to note that the objections raised by the losing parties (partes vencidas) regarding the estimation of damages (daños y perjuicios) claimed — on the grounds that the estimation was conducted by SINAC, which is itself a party with interests in the present proceeding and lacks the minimum substantive elements necessary to establish harm — are not well-taken. This is because the regulatory framework designates precisely that institution as the scientific-technical body responsible for the Natural Heritage of the State (Patrimonio Natural del Estado); its reports are rendered within the scope of its competence, derive from its legal obligations, and its work falls within the constitutional and legal protection of the environment as a fundamental human right. Accordingly, it is not motivated by any interest in institutional or personal benefit or enrichment. This judge finds that the reports in question, as well as the testimony of the expert witness (testigo/perito), extensively, precisely, concretely, and in detail set forth the environmental damage (daño ambiental) caused by the losing parties, in accordance with Article 196 of the General Law of Public Administration.
The parties must recall that the determination of harm — even in the abstract — by the Trial Court, as well as the causal link between each of those areas and a recent, present, and legally attributable environmental damage, are already matters protected by res judicata (cosa juzgada) and therefore foreclosed by preclusion; the enforcement phase is neither a reopening nor a repetition of arguments on the merits. As regards the challenges to Report 007-2024, which establishes an economic valuation of environmental damage (valoración económica del daño ambiental, VEDA) of 25,130,914.29 colones — integrating line items for eliminated forest, carbon, oxygen, landscape value, and administrative expenses — these are not well-founded, inasmuch as the technical and scientific assumptions applied are accepted under current regulatory rules; likewise, the use of indicators and sources over time, including oxygen prices from 2010, carbon references, and ecosystem values drawn from general studies, were not technically refuted by the losing party, and therefore such objections must be rejected.
Consequently, with respect to environmental damages, the results of the VEDA in the "La Parcela" area in Dominicalito de Osa must be recognized; these encompass the cost of eliminated forest, carbon, and oxygen, the landscape cost, administrative expenses, demolition costs, and restoration costs to alleviate, mitigate, and restore the affected environment, and are fixed in the amount of ¢33,755,969.00, as described in the following table:
B. JOINT AND SEVERAL LIABILITY. The judgment being enforced provides: "[...] xv) Regarding the claim, Empresa Hotelera Dominical S.A. and Punta Dominical S.A. are ordered to pay both court costs (costas) to the State, the Contraloría General de la República, and SINAC, together with the respective statutory interest, to be computed from the date the resolution determining the quantum thereof becomes final and until actual payment. With respect to the counterclaim (contrademanda), Empresa Hotelera Dominical S.A., Punta Dominical S.A., Dieciocho Veintiuno S.A., Municipalidad de Osa, INVU, and ICT are ordered to pay both court costs to the Contraloría General de la República, together with the respective statutory interest, to be computed from the date the resolution determining the quantum thereof becomes final and until actual payment. [...]" The Contraloría, in its enforcement brief, requests that: "4. That the liquidation of attorney's fees (costas personales) in favor of the Contraloría General de la República be approved, plus the respective interest until actual payment, as detailed below:
The Procuraduría, for its part, requests approval of the fixing of attorney's fees in favor of the State against Empresa Hotelera Dominical S.A. and Punta Dominical S.A. in the amount of six million colones (₵6,000,000.00), as well as the granting of interest accruing until actual payment, as ordered in judgment n.° 11-2019-IV. It is noted that neither the judgment on the merits, nor the damage-repair claims, nor the liquidations establish a different percentage or measure for each of the losing parties; accordingly, it must be understood that joint and several liability (responsabilidad solidaria) exists among those losing parties. In support of the foregoing, it must be borne in mind that this judge agrees with the State's counsel to the effect that environmental liability is, in addition to being strict (responsabilidad objetiva), also joint and several, requiring no proof of fault or negligence; such liability is assumed as a harmful consequence to the environment and may be directed against the legal representatives of the legal entities and institutions involved in the challenged conduct, pursuant to Articles 28 and 50 of the Constitution; as well as the provisions of Ley N° 7554, Articles 2, 98, 99, 101, and 109; Ley N° 7788, Article 109; and votes 1669-2000, 6514-2002, 4822-2007, and 6613-2007 of the Constitutional Chamber of the Supreme Court of Justice.
Accordingly, the monetary amount imposed in this ruling for environmental damage is jointly and severally owed by Punta Dominical S.A., Empresa Hotelera Dominical S.A., Empresa Dieciocho Veintiuno S.A., INVU, ICT, and the Municipalidad de Osa.---
1. PRECAUTIONARY MEASURES: The Contraloría requested in its claims brief that: "[...] An order be issued, as a precautionary measure (medida de aseguramiento), for the immediate halt of any current or future works being carried out in the area of the Restaurant 'La Parcela' in Dominicalito de Osa. To that end, SINAC and the Municipalidad de Osa shall be directed to verify compliance with the Court's order and to report accordingly. [...]" Judgment N° 11-2019-IV, issued by Section Four of this Court and the subject of the present enforcement proceedings, provided in the relevant part: "viii) It is declared that, with respect to the areas classified as Natural Heritage of the State on the lands described in cadastral survey maps (planos catastrados) numbered: P-863801-2003, P-863803-2003, P-864164-2003, P-865511-2003, P-882230-2003, P-864163-2003, P-883689-2003, and those located on the lands subject to a concession application being processed at the Municipalidad de Osa under the file submitted with certification No. 629-2009, as well as in the public zone (zona pública) where the restaurant and cabin facility known as 'La Parcela' is currently located, the exclusive administration thereof belongs to the Ministry of Environment and Energy through SINAC." In this light, this judge finds it duly established, based on the reports submitted by SINAC and the testimony of the expert witness during the oral enforcement hearing (audiencia oral de ejecución), that tree felling is evidenced — with visible stumps beneath a concrete platform in the construction of a structure resembling a pergola — and that modifications to the areas within the Natural Heritage of the State zone accordingly continue to be carried out.
Consequently, pursuant to Article 50 of the Constitution, Ley Forestal N° 7575, votes 1763-94 and 778-08 of the Constitutional Chamber's case law — which establish the precautionary, remedial, and environmental protection principles — as well as Ley Forestal N° 7575, Ley de Biodiversidad N° 7788, and Ley de Conservación de la Vida Silvestre N° 7317, which impose on MINAE, through SINAC, a series of duties and obligations within its competence in environmental matters, and given the principle of the inviolability of res judicata and the right to effective judicial protection, this judge, grounded in Articles 155 and 156 of the CPCA — which confer all powers and duties necessary for the effectiveness and efficacy of the judgment and authorize the issuance of adequate and necessary measures for its proper enforcement — resolves to grant the request; accordingly, the immediate halt of any current or future works being carried out in the area of the Restaurant "La Parcela" in Dominicalito de Osa is hereby ordered as a precautionary measure.
SINAC and the Municipalidad de Osa, cooperating with that institution, are directed to verify compliance with the Court's order by taking closure and/or referral actions, and to report accordingly within 5 business days. So it is ordered.-- 2. UPDATE OF THE COASTAL REGULATORY PLAN. The Contraloría requested in its claims brief that: "[...] 1. Require the Municipalidad de Osa, INVU, and ICT to report on the actions taken in compliance with the TCA's order set forth in judgment on the merits n.° 11-2019-IV. [...]" Judgment N° 11-2019-IV, issued by Section Four of this Court and the subject of the present enforcement proceedings, provided in the relevant part: "vii) The Municipalidad de Osa, ICT, and INVU are ordered to proceed immediately to make the necessary adjustments to the Coastal Regulatory Plan (Plan Regulador Costero) of Punta Dominical, excluding from such planning the areas classified as Natural Heritage of the State in the above-cited survey maps and those bearing a non-tourism declaration by the ICT, as described above.
The foregoing must be completed and approved within no more than one year, counted from the date this judgment becomes final."-- In this light, this judge finds it duly established that both the ICT and the Municipalidad de Osa reported on the resolutions adopted by the Board of Directors of the Institute and by the Municipal Council, regarding the annulment of permits, concessions, and other matters. However, there is no evidence establishing that the necessary adjustment to the Coastal Regulatory Plan of Punta Dominical was made within the time period set by the judgment on the merits, which constitutes noncompliance. Consequently, also pursuant to Article 50 of the Constitution, Ley Forestal N° 7575, votes 1763-94 and 778-08 of the Constitutional Chamber's case law, Ley de Planificación Urbana N° 4240, Ley Orgánica del INVU N° 1788, Ley Orgánica del ICT N° 1917, and Código Municipal Ley N° 7794 — which impose on those entities a series of duties and obligations within their competence in urban regulatory matters — and given the principle of the inviolability of res judicata and the right to effective judicial protection, this judge, grounded in Articles 155 and 156 of the CPCA, resolves to grant the request; accordingly, the Municipalidad de Osa, ICT, and INVU are ordered to report, within 5 business days, on the necessary adjustments to the Coastal Regulatory Plan of Punta Dominical.--- 3.
IMMEDIATE EVICTION FROM THE PROPERTY: In this matter, by a brief dated January 13, 2026, the companies requested intervention regarding an immediate eviction order (desalojo) issued by the Municipalidad de Osa. By an order issued at eighteen hours and twenty-four minutes on January sixteenth, two thousand and twenty-six, an urgent hearing was scheduled for the Municipalidad concerning the eviction order. Thereafter, by a brief dated January 19, 2026, the Contraloría and the Procuraduría, each separately, addressed the eviction order. Subsequently, by a brief dated January 20, 2026, the Municipalidad reported that the eviction order had been stayed. This matter was raised again during the oral enforcement hearing, and both entities addressed it in their closing briefs; in particular, the following was requested: "6. Order the immediate execution of the definitive eviction and total demolition of all infrastructure, cabins, and commercial buildings unlawfully erected in the 'La Parcela' sector, expressly providing that such material demolition shall be carried out by the Municipalidad de Osa, under the technical supervision of SINAC within the scope of its competence."--- Judgment N° 11-2019-IV, issued by Section Four of this Court and the subject of the present enforcement proceedings, provided in the relevant part: "[...] ix) The occupation exercised by Empresa Hotelera Dominical S.A. over the lands of the public zone of Punta Dominical, at the site where the restaurant and cabin facility known as 'La Parcela' is currently located, together with the structures housing that business, is declared illegitimate; accordingly, the definitive eviction and vacation of that area — the subject of the unlawful authorization for the application of Article 21 of Ley No. 6043, granted by the ICT and the Municipalidad de Osa — is hereby ordered."--- In this light, this judge finds it duly established, based on the SINAC reports and the testimony of both the court-appointed expert (perito judicial) and the expert witness, that as of the oral enforcement hearing the restaurant, parking area, cabins, and other structures housing the business remain in operation, and the definitive eviction and vacation ordered by the said judgment has not been effectuated, thereby evidencing noncompliance.
Consequently, also pursuant to Article 50 of the Constitution, Ley Forestal N° 7575, votes 1763-94 and 778-08 of the Constitutional Chamber's case law, Ley de Planificación Urbana N° 4240, and Código Municipal Ley N° 7794 — which impose on those entities a series of duties and obligations within their competence in urban regulatory matters — and given the principle of the inviolability of res judicata and the right to effective judicial protection, this judge, grounded in Articles 155 and 156 of the CPCA, which confer all powers and duties necessary for the effectiveness and efficacy of the judgment and authorize the issuance of adequate and necessary measures for its proper enforcement, resolves to grant the request; accordingly, the plaintiff/losing companies are hereby ordered, within fifteen calendar days, to voluntarily vacate the restaurant, parking area, cabins, and other structures housing the business, under penalty that, should they fail to do so within that period, the definitive eviction and total demolition of all infrastructure, cabins, and commercial buildings erected in the "La Parcela" sector shall proceed; to that end, the Municipalidad de Osa is commissioned to carry out the eviction and material demolition, under the technical supervision of SINAC within the scope of its competence, in order to prevent further environmental damage. So it is ordered.---
The Contraloría states, regarding the liquidation of court costs: it reiterates the amount of ₡11,000,000.00 detailed in the enforcement brief as attorney's fees for the claim, the counterclaim, the cassation appeal, and the present enforcement phase, and refers to the exceptionally extended duration and the complexity of the litigation, and to the work performed.-- For its part, the State notes that on April 22, 2024, its counsel, with full justification, estimated the fees at 6 million colones, and that the opposing party did not object to them in its closing arguments.-- In opposition, the companies argue, regarding the claimed court costs: they object to the amounts sought as attorney's fees, since — apart from failing to specify, as a percentage, what amounts each party should bear — the claims lack technical grounding based at least on the Bar Association Fee Schedule, which would permit the legal basis for those charges to be determined, and that the amounts are excessive and disproportionate.-- The ICT, in turn, requests that, as to court costs, the matter be resolved in accordance with criteria of prudence and reasonableness, consistent with the amounts objected to in its previous submission.-- The Municipalidad de Osa states, regarding the claimed court costs: it is necessary to note that as to attorney's fees, the Contraloría should have adhered to the limits set forth in the attorney's fee schedule in effect at the time the counterclaim was filed, which dates to 2009; at that time the applicable schedule was the Arancel de Honorarios por Servicios de Abogacía y Notariado established by Decreto Ejecutivo #32493-J, published in the Gaceta #150 of August 5, 2005, and its amendment under Decreto Ejecutivo #34442 of December 17, 2007, which did not wholly replace the schedule in force under the previously cited decree.
The amounts set out in this section of the enforcing counterclaimant's brief DO NOT REFLECT COMPLIANCE WITH THAT SCHEDULE in the amounts sought; the costs must be equitable and not individual, and the calculation was very generic.--- Court's Analysis: A. COSTS OF THE CLAIM: In the present case, the judgment being enforced — Judgment N° n.° 11-2019-IV of 08:15 hours on February 25, 2019, issued by Section IV of the Administrative Court — provided: "POR TANTO (...) the counterclaim filed by the Contraloría General de la República against Empresa Hotelera Dominical S.A., Punta Dominical S.A., Dieciocho Veintiuno S.A., Municipalidad de Osa, Instituto Costarricense de Turismo, and Instituto Nacional de Vivienda y Urbanismo is hereby declared FULLY UPHELD in all its particulars. Consequently: [...] xv) Regarding the claim, Empresa Hotelera Dominical S.A. and Punta Dominical S.A. are ordered to pay both court costs to the State, the Contraloría General de la República, and SINAC, together with the respective statutory interest, to be computed from the date the resolution determining the quantum thereof becomes final and until actual payment.
With respect to the counterclaim, Empresa Hotelera Dominical S.A., Punta Dominical S.A., Dieciocho Veintiuno S.A., Municipalidad de Osa, INVU, and ICT are ordered to pay both court costs to the Contraloría General de la República, together with the respective statutory interest, to be computed from the date the resolution determining the quantum thereof becomes final and until actual payment." Since that judgment is now final, the enforcing party's right to court costs is recognized. In this light, as the Contraloría requests, attorney's fees must be fixed by reference to the monetary claims (economic significance), which correspond to the amounts the plaintiff sought against the defendant parties. That economic significance was established at the preliminary hearing and was the subject of a ruling by the Trial Court; it is to that figure that the percentages set out — for quantified cases — in the Executive Decree in force at the date the claim was filed, which was the Arancel de Honorarios por Servicios Profesionales de Abogacía y Notariado N° 32493, must be applied.
However, Article 76.1 of the Code of Civil Procedure, applied supplementally by virtue of Article 220 of the CPCA, serves as a parameter in the present case, as does the case law of the Sala Primera, the Administrative Appellate Court, and this Court, which establishes — in substance — that "(…) In this regard, the Chamber has established a paradigm shift in this matter since the entry into force of the new Code of Civil Procedure (see ruling 1236-2020). (…) Ley 9142 [sic] aims to make payment to the professional as closely aligned with reality as possible, for which it establishes three variables: attention to the work performed (a subjective factor subject to the judge's prudential assessment), stage (the procedural phase at which the attorney's participation ended), and economic significance of the proceeding (an objective factor) (Article 76.1), all of which are verifiable from the case file; always subject to the decree as the maximum ceiling, and applying the principles of reasonableness and proportionality.
This avoids the award of disproportionate fees and requires the judge to justify the amount granted." (Judgment 679-F-S1-2022 of 8:30 hours on March 22, 2022, and 001674-F-S1-2024 of 09:45 hours on November 28, 2024, of the Sala Primera of the Supreme Court of Justice.) This affords the judge a degree of latitude in determining and fixing court costs, beyond a simple arithmetic exercise or mathematical calculation under the Fee Schedule, such that the schedule is not rigidly binding in its order of priority; accordingly, the judge may fix the attorney's fees in a proceeding once a judgment has been rendered against the losing party, using the conventional, constitutional, and legal criteria of proportionality and reasonableness. In this regard, while the plaintiff's claim for remedies carries a certain economic significance, the assessment reflects the enforcing party's engagement with specific technical and scientific matters that call for a particularly specialized approach — entailing a particularly complex representation requiring technical support in drafting the claim, attending hearings, presenting evidence, the preliminary hearing, and trial — and account is taken of the difficulty of the matter and the extended duration of the proceedings, aspects extensively addressed in Considerando IV of this ruling; the amount is found to be reasonable and proportionate to the work performed.
Accordingly, by way of COSTS OF THE CLAIM, jointly and severally, the amount of THREE MILLION COLONES (₡3,000,000.00) is fixed, to be borne by the two co-plaintiff/losing parties — Empresa Hotelera Dominical S.A. and Punta Dominical S.A.--- Applying the principle of unity of court costs, the amount awarded is divided among the State, the Contraloría General de la República, and SINAC; accordingly, the Contraloría and the State are each awarded ONE MILLION COLONES EXACTLY (₡1,000,000.00), and the remaining amounts are reserved until the other party submits its respective liquidation, as provided in Articles 156, 163, and 165 of the CPCA, since that party may not benefit — through its inaction — from what has been awarded to the enforcing party.-- In the same vein, applying the legal and case law arguments cited above, this judge finds it necessary to weigh the time invested, the complexity of the matter, the engagement with technical and scientific issues, and the resources devoted to responding to the counterclaim, opposing defenses, attending the preliminary hearing and trial — aspects extensively addressed in Considerando IV of this ruling; the amount is found to be reasonable and proportionate to the work performed.
Accordingly, by way of COSTS OF THE COUNTERCLAIM, jointly and severally, the amount of FIVE MILLION COLONES (₡5,000,000.00) is fixed, to be borne by the losing counterdefendants (reconvenidas/vencidas) Empresa Hotelera Dominical S.A., Punta Dominical S.A., and Dieciocho Veintiuno S.A., and the Municipalidad de Osa, INVU, and ICT, in favor of the Contraloría General de la República.--- B. COSTS OF THE CASSATION APPEAL: The Contraloría's counsel asserts a claim for costs in connection with the cassation appeal. In this regard, it must be noted that, pursuant to the Arancel de Honorarios por Servicios Profesionales de Abogacía y Notariado, Decreto Ejecutivo No. 32493, which was in force at the time the claim was filed, cassation costs must be liquidated in accordance with the parameters established in that schedule. In the present matter, the plaintiff party, the ICT, and the Municipalidad de Osa filed cassation appeals against the judgment on the merits; the Sala Primera of the Supreme Court of Justice, by resolution n.° 000861-F-S1-2023 of 10:00 hours on June 8, 2023, ruled: "POR TANTO The appeals filed are hereby rejected.
Costs are to be borne by the applicants."-- Applying the relevant procedural rule and the said judgment — which orders the plaintiff/losing party to pay the costs of the cassation appeal — since a formal cassation appeal was filed in this case, recognition of the minimum statutory amount is warranted; the basis for that amount is found in Article 18 of the cited schedule, with a 25% increase. Accordingly, the amount of ONE MILLION COLONES (₡1,000,000.00) is awarded, to be borne jointly and severally by Empresa Hotelera Dominical S.A., Punta Dominical S.A., ICT, and the Municipalidad de Osa, and in favor of the Contraloría General de la República exclusively.--- C. STATUTORY INTEREST: On the amounts awarded, statutory interest shall accrue pursuant to Articles 706 and 1163 of the Civil Code, from the date this ruling becomes final until actual payment.--- D. COSTS OF THE ENFORCEMENT PHASE: The enforcing party requests payment of court costs for the enforcement phase; this must be denied, because the Sala Primera has characterized this type of ruling as a liquidation order (auto liquidatorio), and pursuant to Article 193 of the Código Procesal Contencioso Administrativo (by negative implication), this type of proceeding does not carry an award of attorney's fees; accordingly, no special award of costs is made for the enforcement of judgment (ejecución de sentencia) phase. (See, inter alia, ruling of the Sala Primera of the Supreme Court of Justice N°000492-A-S1-2016 of nine hours and twenty-five minutes on May nineteenth, two thousand and sixteen.)---
Once this ruling becomes final, and pursuant to Articles 155 and following of the Código Procesal Contencioso Administrativo, the obligor shall deposit the amount ordered into the court's account N° 09-001254-1027-CA - 3 within ONE MONTH.-
POR TANTO
In accordance with the legal and jurisprudential authorities cited, the companies PUNTA DOMINICAL S.A., EMPRESA HOTELERA DOMINICAL S.A., and EMPRESA DIECIOCHO VEINTIUNO S.A. are held jointly and severally liable for the damages and losses (daños y perjuicios) caused to the environment and to the Natural Heritage of the State (Patrimonio Natural del Estado); and the INSTITUTO COSTARRICENSE DE VIVIENDA Y URBANISMO -INVU-, the INSTITUTO COSTARRICENSE DE TURISMO -ICT-, and the MUNICIPALIDAD DE OSA are held jointly and severally liable for the damages and losses arising from the active or omissive administrative conduct (conductas administrativas activas u omisivas) that caused harm to the Natural Heritage of the State and to the environment, in the total amount of THIRTY-THREE MILLION SEVEN HUNDRED FIFTY-FIVE THOUSAND NINE HUNDRED SIXTY-NINE COLONES EXACTLY (¢33,755,969.00).--- As a precautionary measure (medida de aseguramiento), the immediate cessation of any current or future works being carried out in the area of the Restaurant "La Parcela" in Dominicalito de Osa is hereby ordered, and SINAC and the Municipalidad de Osa, the latter cooperating with said institution, are directed to verify compliance with this Tribunal's ruling by taking closure and/or referral actions (clausura y/o derivo), and to report within five business days.--- The Municipalidad de Osa, ICT, and INVU are ordered to report on the adjustments made to the Plan Regulador Costero de Punta Dominical within five business days.--- Within fifteen calendar days, the plaintiff/losing-party companies (empresas actoras/vencidas) are ordered to voluntarily vacate the restaurant, the parking area, the cabins, and all other structures housing the business; under penalty that, should they fail to comply within said period, definitive eviction and complete demolition of all infrastructure, cabins, and commercial buildings erected in the "La Parcela" sector shall proceed, for which the Municipalidad de Osa is commissioned to carry out the eviction and physical demolition, under the technical supervision of SINAC, within its area of competence, in order to proceed as set forth in the judgment and to prevent further environmental harm.--- The co-plaintiff/losing parties (co-actoras/vencidas) Empresa Hotelera Dominical S.A. and Punta Dominical are condemned jointly and severally to pay COURT COSTS OF THE CLAIM (COSTAS DE LA DEMANDA) in the amount of THREE MILLION COLONES (₡3,000,000.00).

Se tienen como tales: A.- Por sentencia n.° 11-2019-IV de las 08:15 horas del 25 de febrero de 2019, dictada por la Sección IV del Tribunal Contencioso Administrativo, se dispuso: “POR TANTO (...) se declara CON LUGAR en todos sus extremos, la contrademanda interpuesta por la Contraloría General de la República contra Empresa Hotelera Dominical S.A., Punta Dominical S.A., Dieciocho Veintiuno S.A., Municipalidad de Osa, Instituto Costarricense de Turismo e Instituto Nacional de Vivienda y Urbanismo. Consecuentemente: i) Se declara la disconformidad sustancial con el ordenamiento jurídico y en razón ello la nulidad absoluta de las siguientes conductas administrativas, así como la de todos los actos y actuaciones conexas, que otorgaron la autorización solicitada por Empresa Hotelera Dominical S.A., para la aplicación del artículo 21 de la Ley No. 6043 en la zona pública de Punta Dominical, en el sitio donde actualmente se localizan las instalaciones del restaurante y cabinas denominado “La Parcela”: a) Acuerdo de la Junta Directiva del ICT, aprobado en la sesión ordinaria No. 5082, artículo 2, inciso I), celebrada el 05 de febrero de 2001; b) Acuerdo de la Junta Directiva del ICT, aprobado en la sesión ordinaria No. 5154, artículo 2, inciso V, celebrada el 14 de enero de 2002 y c) Acuerdo del Concejo Municipal de Osa, aprobado en la sesión extraordinaria No. 06-2002, celebrada el 05 de abril de 2002, punto 12), por medio del cual ese Municipio dispuso: autorizar y aprobar la aplicación del régimen indicado en el artículo 21 de la Ley No. 6043, para el área solicitada por Empresa Hotelera Dominical S.A. y autorizar el inicio de los trámites correspondientes para la obtención del respectivo contrato de concesión. ii) Se declara la disconformidad sustancial con el ordenamiento jurídico y en razón de ello la nulidad absoluta de la modificación al Plan Regulador de Punta Dominical, con el fin de cambiar el uso del suelo establecido e incorporar un uso distinto bajo la aplicación del artículo 21 de la Ley No. 6043, en el sitio donde actualmente se localizan las instalaciones del restaurante y cabinas denominado “La Parcela”.
De ahí que se declaran absolutamente nulas las siguientes conductas administrativas, así como todos los actos y actuaciones conexas, relacionadas con las mismas: a) Acuerdo de la Junta Directiva del ICT, aprobado en sesión ordinaria No. 5281, artículo 5, inciso IX, celebrada el 09 de diciembre de 2003; b) Oficio No. PU-C-D-532-2004 del 22 de abril de 2004, emitido por la Dirección de Urbanismo del INVU; c) Acuerdo del Concejo Municipal de Osa, aprobado en la sesión ordinaria No. 08-2005, capítulo VI), celebrada el 23 de febrero de 2005, y ratificación otorgada en la sesión ordinaria No. 09-2005, capítulo V), celebrada el 02 de marzo de 2005 ; d) Acuerdo del Concejo Municipal de Osa, aprobado en la sesión ordinaria No. 31-2008, celebrada el 06 de agosto de 2008 y publicado en el Diario Oficial La Gaceta No. 40 del 26 de febrero de 2009, e) Acuerdo del Concejo Municipal de Osa, aprobado en la sesión ordinaria No. 13-2009, capítulo IV) Correspondencia, punto 6), celebrada el 21 de enero de 2009, donde se dispuso declarar con lugar el recurso de revocatoria y el incidente de nulidad, presentado por Empresa Hotelera Dominical S.A., revocando el acuerdo adoptado en el punto 2) del capítulo III de la sesión ordinaria No. 32-2008 del 13 de agosto de 2008. iii) Se declara a la disconformidad sustancial con el ordenamiento jurídico y consecuentemente la nulidad absoluta de las concesiones otorgadas a las empresas Punta Dominical S.A., Empresa Hotelera Dominical S.A. y Empresa Dieciocho Veintiuno S.A., referidas a terrenos ubicados en la zona restringida de la zona marítimo-terrestre comprendida dentro del Plan Regulador de Punta Dominical.
De ahí que se declaran absolutamente nulas las siguientes conductas administrativas, así como todos los actos y actuaciones conexas, relacionadas con las mismas: a) Acuerdo del Concejo Municipal de Osa, adoptado en sesión ordinaria No. 07-2004, capítulo VI), punto 1), celebrada el 18 de febrero de 2004, en cuanto aprobó los proyectos de resolución presentados por el Alcalde Municipal, para el otorgamiento de concesiones y firma de los respectivos contratos a nombre de: Empresa Hotelera Dominical S.A., parcela con un área de 3 hectáreas 7697.12 metros cuadrados; Punta Dominical S.A., parcela con un área de 2 hectáreas 4988.21 metros cuadrados; Punta Dominical S.A., parcela con un área de 4886.45 metros cuadrados; Punta Dominical S.A., parcela con un área de 13 hectáreas 6167.28 metros cuadrados; y Empresa Dieciocho Veintiuno S.A., parcela con un área de 9 hectáreas 6913.43 metros cuadrados; b) Los contratos de concesión firmados el 31 de marzo de 2004, entre la Municipalidad de Osa y la empresa Punta Dominical S.A., correspondientes a los terrenos descritos en los planos catastrados con número: P-864164-2003, P-882230-2003, P-883689-2003.
El contrato firmado en esa misma fecha entre la Municipalidad de Osa y Empresa Hotelera Dominical S.A., correspondiente al terreno catastrado No. P-865511-2003, y el contrato firmado entre la Municipalidad de Osa y Empresa Dieciocho Veintiuno S.A., correspondiente al terreno con plano catastrado No. P-864163-2003, así como los addendums a dichos contratos suscritos el 20 de setiembre de 2004; b) Las resoluciones con número G-2025-2004 y G-2026-2004 del 18 de noviembre de 2004, así como las resoluciones con número G-250-2005, G-251-2005 y G-252-2005, éstas de fecha 04 de febrero de 2005, todas emitidas por la Gerencia del ICT, correspondientes a la aprobación de los contratos de concesiones suscritos entre la Municipalidad de Osa con las empresas Punta Dominical S.A., Empresa Hotelera Dominical S.A. y Empresa Dieciocho Veintiuno S.A., atinentes a los terrenos con planos catastrados número: P-864164-2003, P-882230-2003, P-883689-2003, P-865511-2003 y P-864163-2003; c) La inscripción de las siguientes concesiones en el Registro Nacional, bajo matrículas: 1421-Z-000, 1422-Z-000 y 2133-Z-000 del Partido de Puntarenas y d) Los planos inscritos en el Catastro del Registro Nacional, con número: P-864164-2003, P-882230-2003, P-883689-2003, P-865511-2003 y P-864163-2003. iv) En relación con las solicitudes de concesiones en trámite ante la Municipalidad de Osa a nombre de la empresa Punta Dominical S.A., correspondientes a los terrenos ubicados en la zona restringida, con planos catastrados número: P-863801-2003, P-863803-2003 y los que corresponden a la solicitud de concesión que se tramita bajo el expediente aportado a los autos con la certificación No. 629-2009, se declara: a) La nulidad absoluta de los referidos planos y croquis que amparan esas solicitudes de concesión; b) Que la aprobación de dichas solicitudes resulta absolutamente improcedente en cuanto dichos terrenos involucran áreas que forman parte del Patrimonio Natural del Estado o se encuentran fuera de los sectores con declaratoria turística por parte del Instituto Costarricense de Turismo; c) Que la Municipalidad de Osa y el Instituto Costarricense de Turismo, se encuentran en el ineludible deber legal de respetar los límites y reglas establecidas en el ordenamiento jurídico con respecto al trámite y otorgamiento de concesiones en terrenos de la zona marítimo-terrestre comprendida dentro del Plan Regulador de Punta Dominical, incluyendo por supuesto los señalados a lo largo de esta sentencia y en particular deberán:
Se peticiona por parte de la Contraloría General, lo siguiente: 1. Requerir a la Municipalidad de Osa, al INVU y al ICT que informen sobre las actuaciones que han sido ejecutadas en cumplimiento a lo dispuesto por el TCA mediante la resolución de fondo n.° 11-2019-IV. // 2.- Se declare la responsabilidad solidaria de las empresas Punta Dominical S.A., Empresa Hotelera Dominical S.A., Empresa Dieciocho Veintiuno S.A., así como de las dependencias públicas contrademandadas, sea el Instituto Costarricense de Turismo, el Instituto Nacional de Vivienda y Urbanismo y la Municipalidad de Osa y, en consecuencia, que ordene la cancelación de ¢33.755.969,00, monto que corresponde al daño ambiental generado producto de sus actuaciones y/u omisiones.-- 3. Se ordene como medida de aseguramiento la paralización, de forma inmediata, de cualquier obra actual o futura que se esté desarrollando en el sector del Restaurante “La Parcela” en Dominicalito de Osa. Y para tal efecto, se disponga al SINAC y a la Municipalidad de Osa verificar el cumplimiento de lo dispuesto por el Tribunal y se proceda a informar lo que corresponda. 4. Que se apruebe la liquidación de costas personales a favor de la Contraloría General de la República, más los intereses respectivos hasta su efectivo pago, de la forma en que se detalla a continuación:
Por su parte, la Procuraduría peticiona aprobar la fijación de costas personales en favor del Estado contra Empresa Hotelera Dominical S.A. y Punta Dominical S.A. por la suma de seis millones de colones (₵6.000.000,oo), así como conceder los intereses que se generen hasta su efectivo pago, conforme se ordenó en la sentencia n.° 11-2019-IV.---
A.- DE LA PARTE EJECUTANTE: 1.- DE LA CONTRALORÍA GENERAL DE LA REPÚBLICA. La Contraloría formula ejecución de sentencia, e informa sobre las actuaciones realizadas, sean: 1. Análisis de la demanda y la medida cautelar interpuesta por Empresa Hotelera Dominical S.A, cédula jurídica 3-101-048163 y Punta Dominical S.A., cédula jurídica 3-101-024072, mediante las cuales se solicitó que se declarara la disconformidad con el ordenamiento jurídico de las actuaciones desplegadas por la CGR en relación con el informe n.° DFOE-SM-14-2008. // 2. Preparación y envío de apersonamiento por parte de la Contraloría General de la República. // 3. Análisis y contestación de la medida cautelar solicitada por la parte actora. // 4. Contestación de la demanda, así como interposición de excepciones. La Contraloría General, en dicha oportunidad, solicitó: “Conforme a las argumentaciones antes expuestas, oponemos a la citada demanda las excepciones de falta de derecho, falta de legitimación activa y pasiva, y falta de interés actual, las cuales solicitamos que sean acogidas en la resolución de fondo y, por ende, se declare sin lugar la demanda en todos sus extremos, debiéndose condenar a la parte actora al pago de ambas costas derivadas de este proceso.” // 5.
Elaboración y presentación de una contrademanda en contra de las empresas Hotelera Dominical Sociedad Anónima, cédula jurídica n.° 3-101-048163 y Punta Dominical Sociedad Anónima, cédula jurídica n.° 3-101-024072, así como la Municipalidad de Osa, el Instituto Nacional de Vivienda y Urbanismo, el Instituto Costarricense de Turismo y la Empresa Dieciocho Veintiuno Sociedad Anónima, cédula jurídica n.° 3-101-154599. // 6. Participación en la audiencia preliminar celebrada el 16 de agosto de 2010. // 7. Participación en la continuación de la audiencia preliminar celebrada el 24 de agosto de 2010, ya que por la complejidad del caso y la cantidad de partes involucradas no fue posible finalizar dicha audiencia en una sola sesión. // 8. Preparación y participación en la audiencia de juicio oral y público celebrada el 19 de mayo de 2011. // 9. Preparación y participación en la continuación de la audiencia de juicio oral y público celebrada el 7 de febrero de 2013. // 10.
Participación en audiencia de conciliación celebrada el 23 de marzo de 2013. // 11. Preparación y participación en la audiencia de juicio oral y público celebrada el 30 de enero de 2019. // 12. Lectura y análisis de la resolución de fondo n.° 11-2019-IV de las 08:15 horas del 25 de febrero de 2019, dictada por la Sección IV del Tribunal Contencioso Administrativo y Civil de Hacienda. // 13. El 30 de noviembre de 2022, se contestó audiencia otorgada por la Sala Primera en virtud de los recursos de casación interpuestos por la parte actora, el ICT y la Municipalidad de Osa. // 14. Lectura integral, análisis y seguimiento de la resolución n.° 000861-F-S1-2023 de las 10:00 horas del 8 de junio de 2023 emitida por la Sala Primera. // 15. Elaboración de varios oficios dirigidos al SINAC, ICT, INVU y Municipalidad de Osa, a fin de procurar el acatamiento de la resolución de fondo n.° 11-2019-IV, dictada por el Tribunal Contencioso Administrativo y Civil de Hacienda.
Adicionalmente expone la metodología y resultados de la valoración económica del daño ambiental (VEDA) en la zona de “La Parcela” en Dominicalito de Osa es de ¢33.755.969,00, tal y como se describe en el siguiente cuadro:
Durante la audiencia oral de ejecución ratifica las pretensiones, aclara lo relativo a las empresas demandadas, y señala que ha sido un proceso complejo y técnico.- En su escrito de conclusiones a la audiencia oral de ejecución refiere a la cosa juzgada material de la sentencia de fondo, ampliamente a los estudios periciales, y finalmente peticiona: 1. Desestimar íntegramente el informe pericial rendido por el perito judicial Ing. Juan Ramón Vargas Arias, por oponerse de forma flagrante a la cosa juzgada material y basarse en valoraciones subjetivas e impresiones personales que anulan su idoneidad técnica. // 2. Aprobar en todos sus extremos la liquidación económica del daño ambiental planteada por la CGR con base en el criterio pericial, objetivo y científico de la Administración Forestal del Estado (SINAC), ordenando la condena por la suma líquida y exigible de ₡33.755.969,00. // 3. Declarar la responsabilidad solidaria de todas las empresas privadas y administraciones públicas ejecutadas respecto del pago de la VEDA y las costas del proceso, ordenando que el depósito correspondiente al daño ambiental se realice de forma obligatoria a la cuenta del fondo de parques del SINAC. // 4.
Aprobar la liquidación de costas personales a favor de la CGR por la suma de ₡11.000.000,00, desglosada en los términos expuestos en el escrito de ejecución, ordenando el cómputo de los intereses legales correspondientes hasta su efectivo pago. // 5. Mantener los embargos preventivos sobre las cuentas bancarias de las empresas ejecutadas, a efectos de asegurar los fondos necesarios para el resarcimiento del daño ecológico decretado. // 6. Ordenar la ejecución inmediata del desalojo definitivo y la demolición total de la totalidad de las infraestructuras, cabinas y edificaciones comerciales levantadas de forma ilegal en el sector de "La Parcela", disponiendo expresamente que dicha demolición material debe ser realizada por la Municipalidad de Osa, bajo la supervisión técnica del SINAC en lo de su competencia. // 7. Ordenar a la Municipalidad de Osa que remita de forma inmediata al ICT y al INVU, la totalidad de la información técnica requerida para materializar la actualización y rectificación del Plan Regulador Costero de Punta Dominical, debiendo informar de dicho cumplimiento al Tribunal.--- 2.- DE EL ESTADO: Durante la audiencia oral de ejecución ratifica las pretensiones, explica que el Estado no formuló reconvención, e informa que se pidió la ejecutoria de la sentencia, y se presentó al Registro Nacional la cancelación de concesiones, (aporta documentos).- En su escrito de conclusiones a la audiencia oral de ejecución, refiere a: - Sobre el Incumplimiento grave de la sentencia 11-2019-IV.
La sentencia 11-2019-IV quedó firme con el voto 861 de las 10:00 hrs. del 8 de junio de 2023, notificado el 27 de ese mes, donde la Sala Primera rechazó los recursos formulados. Tres años después de su firmeza y autoridad de cosa juzgada material, la sentencia 11-2019-IV es incumplida por Punta Dominical S.A., Empresa Hotelera Dominical S.A. y Empresa Dieciocho Veintiuno S.A. Apunta que el Ing. Vargas Arias por escrito (conclusión 3) y oralmente el 3 de junio de este año, señaló que las obras que invaden la zona pública persisten. Mismo resultado se obtiene de los informes técnicos SINAC-ACOSA-DT-PNE-Inf-007-2024 y SINAC-ACOSA-DT-PNE-Inf-008-2024, emitidos con base en el artículo 58 de la Ley Forestal, y de la declaración de la Ing. Daniela Valverde Gamboa, rendida el mismo día. Así, las citadas empresas tienen tres años de lucrar aún más en forma gratuita e indebida en la zona pública de la zona marítimo terrestre.
Expone además que ante ese incumplimiento, como esa zona pública está bajo administración del SINAC en los términos de las sentencias firmes 11-2019-IV y 861-F-S1-2023, lo propio es que se prevenga su desalojo inmediato y se comisione al Área de Conservación de Osa para que verifique su cumplimiento, con el auxilio de la Fuerza Pública de ser necesario. Para ello, se recomienda que los numerales 156 y 157 de la Ley 8508 otorgan el Juez ejecutor los poderes necesarios para la plena efectividad y eficacia de lo ordenado en sentencia. - Sobre la Responsabilidad por daño ambiental es solidaria. Advierte que la responsabilidad ambiental además de ser objetiva, es solidaria, que no requiere demostrarse la culpa o negligencia. Se asume ese riesgo como consecuencia dañosa para el ambiente y se puede dirigir contra los representantes legales de las personas jurídicas e instituciones involucradas en las conductas impugnadas (artículos 28 y 50 constitucionales; Ley 7554, artículos 2, 98, 99, 101, 109, Ley 7788, artículo 109; votos constitucionales 1669-2000, 6514-2002, 4822-2007 y 6613-2007).
Por ello, el monto económico que se imponga por daño ambiental a Punta Dominical S.A., Empresa Hotelera Dominical S.A., Empresa Dieciocho Veintiuno S.A, INVU, ICT y Municipalidad de Osa ha de ser a prorrata.--- 3.- DEL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC). Durante la audiencia oral de ejecución informa que no ha presentado liquidación de costas pero sí el informe de análisis de valoración de daño ambiental.- En su escrito de conclusiones a la audiencia oral de ejecución apunta. Finalmente peticiona que es evidente que el informe del perito Juan Ramón Vargas Arias carece de toda utilidad probatoria y técnica, debiendo ser descartado, y que en su lugar se acojan en todos sus extremos las conclusiones de los informes SINACACOSA-DT-PNE-Inf-007-2024 y 008-2024 rendidos por la Ing. Daniela Valverde Gamboa, los cuales son el fiel reflejo de la verdad real, respaldados por la ciencia, la técnica y la legalidad vigente.-- B.- DE LA PARTE EJECUTADA/ VENCIDA: 1.- DEL INSTITUTO COSTARRICENSE DE TURISMO: El ICT en su escrito refiera a que en los oficios SA-028-2013 del 15 de abril de 2013 y SJD-129-2013 del 10 de abril del 2013, en donde se comunican el acuerdo de Junta Directiva del ICT, de Sesión Ordinaria de N° 5793, Artículo 5, inciso II, celebrada el día 09 de abril del 2013, donde aprueba propuesta de conciliación, anula parcialmente actos y actuaciones, mismos que ante la prevención, aclara que los actos anulatorios que se adjuntan al presente escrito, siguen estando vigentes.-- Sobre la ejecución de sentencia, apunta que no tiene objeción en cuanto a la determinación del daño por parte del SINAC.
No obstante, se encuentra en total desacuerdo en cuanto a la solicitud de la CGR que se declare la responsabilidad solidaria de las contrademandadas para efectos del pago del daño. Lo anterior provocaría modificar la sentencia que se ejecuta; puesto que esta, en cuanto a la condena al pago de daños. Y aborda también la liquidación de costas, y formula liquidación de la contrademanda.- Durante la audiencia oral de ejecución hace referencia la liquidación presentada por la Contraloría, reitera los acuerdos de la Junta Directiva para ejecutar la sentencia, y peticiona el fraccionamiento de la condena en costas.-- En su escrito de conclusiones a la audiencia oral de ejecución peticiona: 1. Tener por manifestado expresamente que el ICT no presenta objeción alguna en cuanto a la prueba de la cancelación de las concesiones y demás actuaciones conexas ya anuladas en cumplimiento de sentencia. // 2.
Tener por acreditado el cumplimiento de sentencia por parte del ICT en lo que atañe a la anulación de actos propios, reconocimiento de Patrimonio Natural del Estado, cancelación de concesiones y demás actuaciones institucionales documentadas. // 3. Al momento de valorar la prueba técnica sobre daño ambiental, desestimar, o en su defecto relativizar de manera sustancial, la eficacia probatoria de los informes SINACACOSA-DT-PNE-Inf-006-[007]-[007]2024, por sus deficiencias metodológicas, la insuficiente línea base histórica, la falta de depuración temporal de las obras y la aplicación de indicadores económicos generales no suficientemente ajustados al caso. // 4. Otorgar mayor valor persuasivo al enfoque metodológico contenido en el informe pericial de Juan Ramón Vargas Arias, particularmente en cuanto a línea base temporal, evidencia histórica, cronología de estructuras y análisis comparativo del uso del suelo y del posible cambio ambiental negativo. // 5.
Rechazar la pretensión de declarar responsabilidad solidaria entre las administraciones contrademandadas para efectos del pago de daños, por no haber sido ello dispuesto en la sentencia que se ejecuta. // 6. En subsidio, si se fijare alguna suma líquida por concepto de daño, limitarla estrictamente a afectaciones específicas, temporalmente determinadas, técnicamente individualizadas y debidamente probadas, sin admitir automatismos de cuantificación ni extrapolaciones generales. // 7. En cuanto a costas, resolver con apego a criterios de prudencia y razonabilidad, conforme a los montos objetados por esta representación en su gestión anterior.--- 2.- DEL INSTITUTO NACIONAL DE VIVIENDA Y URBANISMO: El INVU en su contestación se manifiesta sobre las acciones tomadas, y de la liquidación de la Contraloría, y solicita que los jueces ejecutores se apegan al monto mínimo de costas, solicitamos se aprueben los montos estipulados en el arancel vigente, decreto ejecutivo N° 32493, dividiéndose las mismas entre las partes condenadas--- No concurrió a la audiencia oral de ejecución, pese a estar debidamente notificada.--- 3.- LAS EMPRESAS PUNTA DOMINICAL SRL, EMPRESA HOTELERA DOMINICAL SRL y DIECIOCHO VEINTIUNO S.A. Las empresas, bajo una misma representación letrada -como consta en autos-, al contestar la audiencia refieren a la sentencia de fondo, exponen que su rechazo a las afirmaciones del SINAC, así como se oponen al informe de valoración de daño ambiental, y peticionan que: 1.- Se rechace la demanda de ejecución propuesta por la Contraloría General de la República, así como la totalidad de documentos presentados por el Sinac. // 2.- Se designe perito valuador para que realice la estimación del eventual daño ambiental. // 3.- Sea integrado a este proceso el Registro Nacional de la Propiedad, así como los titulares de los planos catastrados indicados en el acápite 3 arriba citado, incorporando también, a aquellos administrados que han gestionado ante la Municipalidad de Osa, desde el inicio de este proceso hasta la fecha, conforme la información que debe brindar esa corporación.
Durante la audiencia oral de ejecución se pone a los escritos de la Contraloría como de la Procuraduría, señala que no se menciona el arancel para justificar las costas, que la fundamentación es ayuna y se opone a la cuantificación del daño ambiental.--- En su escrito de conclusiones a la audiencia oral de ejecución refirió a la sentencia de fondo, ampliamente a los informes del SINAC y del perito judicial, solicita otorgar mayor valor persuasivo al enfoque metodológico contenido en el informe pericial de Juan Ramón Vargas Arias, y en cuanto a costas, resolver con apego a criterios de prudencia y razonabilidad, obviando lo pretendido por la ejecutante por no ajustarse a derecho.--- 4.- DE LA MUNICIPALIDAD DE OSA. El Gobierno Local realiza oposición a los daños y perjuicios que se pretenden, solicita como prueba para mejor resolver un perito judicial para la valoración de los daños y perjuicios ambientales y al Patrimonio Natural del Estado (PNE), así como solicitar al Departamento de Zona Marítimo Terrestre de la Municipalidad de Osa, informe sobre las diversas gestiones interpuestas por dichos administrados y de esta forma puedan ser traídos al proceso en defensa de sus derechos.- Durante la audiencia oral de ejecución informa que se tomaron los acuerdos municipales que anularon las concesiones, solicita la distribución equitativa de la condena en costas entre las partes vencidas, insiste que no hay desglose de actividades y lo pretendido resulta excesivo, y que debería ser el mínimo del arancel.---- En su escrito de conclusiones a la audiencia oral de ejecución indica que se referirá al cumplimiento por parte de la Municipalidad de Osa de los distintos aspectos ordenados de la anulación de los acuerdos municipales y demás actuaciones administrativas en la Sentencia.
Sobre los documentos aportados por la Procuraduría que viene a corroborar la cancelación de las referidas concesiones otorgadas a las empresas actoras, tal y como lo dispuso con su sentencia el Tribunal Contencioso Administrativo. [...] Se refiere ampliamente a los informes periciales.--
A.- DEL PRINCIPIO DE TUTELA JUDICIAL EFECTIVA: De acuerdo con los artículos 153 constitucional y 1°, pfo 2°, de la Ley Orgánica del Poder Judicial corresponde a los Tribunales conocer las causas que la Constitución y la ley le señalan, resolverlas definitivamente y "ejecutar las resoluciones que pronuncie", sea, la ejecución plena e íntegra de las sentencias dictadas por el Tribunal de juicio, cuando contengan una obligación de hacer, de no hacer o de dar, y estas no sean cumplidas voluntariamente por la parte obligada”. (CPCA, art. 156.3). La ejecución de la sentencia es parte esencial del derecho a la tutela judicial efectiva e imprescindible para la efectividad del fallo definitivo y firme, en los términos que consigna, sin alteración o desnaturalización. A ese fin, el CPCA establece que “En la fase de ejecución de sentencia, el Juez ejecutor tendrá todos los poderes y deberes necesarios para su plena efectividad y eficacia” (art. 155.2).
“La sentencia deberá ser cumplida, en la forma y términos consignados en ella” (art. 156.1). “La sentencia firme del Tribunal deberá ser ejecutada de inmediato (…)” (art. 157). Los ordinales 161 inc. b, 162, 175.1, etc), garantizan la satisfacción real del derecho declarado a favor de la parte victoriosa. “El derecho a la tutela judicial efectiva requiere que la resolución judicial se cumpla, de lo contrario el reconocimiento de derechos establecidos en ella será vano, una mera declamación de intenciones, con grave lesión a la seguridad jurídica. La sentencia a que da lugar la demanda termina una etapa del proceso (la de conocimiento), pero no el proceso mismo, que continúa en una segunda etapa (la de ejecución) y que termina cuando se ha satisfecho la pretensión del accionante." (Sala Primera de la Corte, sentencia 348-2016). “Sería inaceptable que una sentencia quede en letra muerta y nunca sea llevada a la realidad, aniquilando sus efectos.
Por eso, el juez cumple una función de garante, y se encuentra obligado a velar por la plena y efectiva ejecución, tanto de forma ágil como real.” (Sala Primera de la Corte, sentencias 675-2007, 1443-2012, 122-2016 y 2409-2022). B.- DEL PRINCIPIO DE INTANGIBILIDAD DE LA COSA JUZGADA EN LA FASE DE EJECUCIÓN: El artículo 156 inciso 1 del Código Procesal Contencioso Administrativo, indica que “1) La sentencia deberá ser cumplida, en la forma y los términos consignados por ella”.- En este sentido la Sala Primera de la Corte Suprema de Justicia, mediante su resolución de las 11:45 horas del 12 de octubre de 2021, ha manifestado: “V.- En otro orden de ideas, en lo concerniente a que el Juzgado no otorgó los daños y perjuicios pretendidos, se hace necesario recordar, esta Cámara ha dispuesto: “El proceso de ejecución de sentencia procura materializar la condena -abstractaimpuesta al perdidoso, de otorgar aspectos diferentes -o contrarios- al pronunciamiento que da lugar a la ejecución, o contra personas que no resultaron condenadas, se vulnera la cosa juzgada (al respecto, se puede consultar el fallo de esta Sala no. 001360-F-S1-2017 de las 15 horas del 07 de noviembre de 2017)”.
Fallo no. 383 de 9 horas 50 minutos del 9 de mayo de 2019. Consecuentemente, tanto lo ejecutado como lo que se conceda en la sede de cita debe corresponderse con lo declarado en la sentencia que se ejecuta. De ahí, en esta clase de proceso se pretende ajustar a la situación de hecho la norma individual amparada en el fallo ejecutoriado, con el propósito de garantizar el derecho de la parte amparada. Por ello, el objeto es proporcionarle efectividad a lo mandado en la sentencia de condena para satisfacer el interés de la ejecutante, en cuanto resultó victoriosa en sede constitucional. Por consiguiente, solo se admiten en la vía de ejecución las pretensiones referidas a brindar efectividad a lo ordenado en el fallo de condena. La trascendencia y contenido de lo que se disponga en esta fase son determinados por lo fijado en la sentencia que se ejecuta. Los límites subjetivos y objetivos del asunto se encuentran definidos por la propia resolución ejecutoria, en correspondencia con los efectos positivos y negativos resultantes y al principio de intangibilidad de la cosa juzgada -artículo 156 del CPCA-.
Este principio obliga a que la ejecución deba realizarse con sustento en los propios términos impuestos en el fallo firme, lo cual limita el marco de acción. Como se expresó en el considerando III, la persona juzgadora, resolvió con base en la prueba aportada por la ejecutante, -por lo que distinto a lo argüido, los elementos de convicción si fueron apreciados-, lo acreditado no tenía relación causal con lo otorgado en la sentencia ejecutoriada. […] Ha de acotarse el principio de intangibilidad de la cosa juzgada manda que la ejecución se efectúe con fundamento en los términos impuestos en el fallo firme, lo cual limita el ámbito de acción, -artículo 156 del CPCA-. Su objeto es salvaguardar la integridad de las sentencias revestidas con la autoridad de la cosa juzgada material, por lo que la persona juzgadora se encuentra impedida de permitir alguna conducta que altere, elimine, varíe o añada al contenido de la resolución obligaciones adicionales no dispuestas en ella, lo cual se castiga con la nulidad.
En consecuencia, no se produce el yerro acusado, dado que si no se concedió lo reclamado por la ejecutante lo fue porque no guarda relación con lo otorgado en la sentencia firme ejecutada. De ahí, procede desestimar el cargo.”.- Ergo, la sentencia revestida de autoridad de cosa juzgada material es inmutable, porque deviene inmodificable, y coercible, al poder ejecutarse forzosamente. La parte cuyo derecho le ha sido declarado en sentencia “puede ejecutar ese fallo sin restricción, en la medida de lo resuelto y el juez no podrá negarse a su cumplimiento” (Tribunal Contencioso Administrativo, voto 101-2021-VI). Sobre esas características de inmutabilidad y definitividad absoluta del derecho declarado, ver del Tribunal Contencioso Administrativo los votos 2006-2002-I, 280-2002- I, 151-2002- II, 130-2008-II, 16-2008-VI; y, de la Sala Primera, las sentencias 740-1999, 481-2000, 680- 2002, 1015-2004, 932-2006 y 111-2015.- C.- DE LA PRUEBA PERICIAL Y OTROS MEDIOS PROBATORIOS: Según expone la doctrina aplicable a la materia, respecto al peritaje debe valorarse que todo perito debe mantener su independencia de criterio y el dictamen debe ser ser imparcial, que en caso de rendirse dictamen pericial privado o judicial, si existen vínculos personales con las partes o interés económico esos son motivos serios para dudar de la sinceridad del perito porque lo que se busca a través de la garantía de la imparcialidad, que no se desvirtué en el proceso su figura de tercero, evitando que por determinadas circunstancias, pueda llegar a dictaminar la cuestión favoreciendo a una de las partes.- Además que la finalidad de la prueba de peritos, consiste en acreditar los hechos que fundamentan las pretensiones de las partes en el proceso, con la particularidad, de que el objeto de la prueba pericial son hechos que no son del común saber de las partes o del juez, de modo que el perito, mediante su informe o dictamen, proporciona al tribunal los conocimientos técnicos necesarios para la valoración de los hechos objeto de la controversia.
Se garantiza el mínimo necesario de imparcialidad científica, objetiva, que debe concurrir en el trabajo de examen y emisión del dictamen pericial, cuando el perito actúa conforme con los criterios válidos y vigentes en la disciplina que se trate y los aporta al órgano judicial para su valoración.- La abundante jurisprudencia de la Sala Primera sobre lo relativo a los peritajes ha expuesto: “Es menester señalar que esta Cámara ha expresado, en lo tocante al valor probatorio de los peritajes: (. . .) que tienen como objetivo auxiliar al juez en conocimientos científicos que le son ajenos, pero más que verdades absolutas que sustituyan su criterio, su contenido objetivo y científico, no limita su labor de apreciación; sólo tienen el propósito de orientarlo, aportándole elementos que le permitan apreciar las circunstancias indispensables para la decisión que debe adoptar. Es claro entonces que, apartarse de un criterio técnico, y justificar el propio, lejos de constituir un exceso de poder, es un ejercicio inherente a la labor del juzgador en la apreciación de la prueba (Resolución no. 43-2007 de las 9 horas 10 minutos del 26 de enero de 2007, en igual sentido pueden consultarse las sentencias números 765 de las 15 horas con 40 minutos del 24 de julio de 2009 y 468 de las 10 horas 45 minutos del 7 de abril de 2011).
En tesis de principio, queda claro, nada obsta para que un Juzgador se aparte de un criterio pericial, siempre y cuando, justifique de manera racional tal determinación. (…) Cabe resaltar, por la especialidad de la materia propia de una pericia técnica, resulta imprescindible la existencia de contraprueba de igual linaje que desvirtúe las conclusiones del perito (sea que el informe se encuentra alterado o que no corresponde con la realidad). La carga de la prueba, al tenor del mandato 317 del CPC, le atañe a quien alega un derecho o una excepción; por lo tanto, al existir un peritaje donde se cuantifican los daños alegados, para desvirtuar su valor debía aportarse otro elemento probatorio que demostrara, fehacientemente, cuál es el cálculo correcto. De conformidad con lo preceptuado en el inciso 2) del ordinal 90 del CPCA, la parte demandada pudo ofrecer prueba al respecto.”.-
La Contraloría General en su escrito de ejecución, presenta un análisis sobre daño ambiental, señala que: [...] mediante el oficio n.° 16662 (DJ-1832) del 20 de noviembre de 2023, la CGR solicitó al Sistema Nacional de Áreas de Conservación (SINAC) “la confección de un informe de identificación y valoración del daño ambiental en los terrenos de la zona pública y la zona restringida de Punta Dominical, descritos en la resolución n.° 11-2019-IV -la cual se adjunta-, informe en el que se debe determinar con claridad la existencia del daño ambiental y su cuantía.”. Que en atención a lo anterior, el 12 de febrero de 2024 la Licda. Daniela Valverde Gamboa, Coordinadora de Patrimonio Natural del Estado del Área de Conservación de Osa del SINAC, emitió el informe n.° SINAC-ACOSA-DT-PNE-Inf-006-2024, por medio del cual informó sobre el levantamiento de campo que se llevó a cabo en el sector del restaurante “La Parcela” en Dominicalito de Osa, según se indicó en dicho informe “Se toman puntos con georreferenciación, se miden las dimensiones de las infraestructuras, caminos, parqueo, senderos y demás. Se toman fotografías y se hace una descripción del sitio.” La información referente al levantamiento de las infraestructuras, caminos, parqueo y demás, se resume en el siguiente cuadro:
Continúa señalando el informe que: [...] además de las cabañas, caminos y restaurante construidos en la zona, “se observó en la inspección de campo, que se están realizando trabajos recientemente. Se observó la construcción de un mirador en el punto N 1019727 y E 517176, las mejoras del sendero hacia el mirador. Se observó inclusive la corta de árboles exactamente donde se encuentra la plataforma del mirador.” (Se agregó el destacado). [...] se aprecia, con claridad, las construcciones y obras que se han seguido realizando en la zona, esto en un abierto y grosero incumplimiento a una sentencia judicial firme y en detrimento del Patrimonio Natural del Estado. [...] Con base en el levantamiento de campo anterior, el 13 de febrero de 2024 la Licda. Valverde Gamboa emitió el informe n.° SINAC-ACOSA-DT-PNE-Inf-007-2024, a fin de llevar a cabo la valoración económica del grave daño ambiental en el sector del restaurante “La Parcela” en Dominicalito de Osa, en relación con lo cual se señaló que: “Este sector cumple funciones muy importantes como mantener la conexión entre ecosistemas, permitiendo el continuo tránsito de fauna, establecimiento de flora, sirve como hábitat a diferentes especies como parte de nuestro PNE, además de reservorios de carbono.”--- [...]".---
El Ing. Juan Ramón Vargas Arias, rinde el informe pericial N° 3235, detalla -en lo medular- que:
Continúa el informe: [...] 2) Uso actual de la finca. El predio tiene una cobertura conformada por el cultivo de especies introducidas y especies nativas establecidas que conforman un uso actual de huerto, la cual fue promovida después que se eliminó la vegetación natural. La evidencia indica que esta asociación vegetal tiene muchos años de estar en el sitio, el ejemplo más palpable, son los árboles de mango que además de ser una especie no nativa, en el lugar se encuentran plantados formando una estructura geométrica lineal propia de una siembra (véase figura 20) y que actualmente tienen alturas mayores a 20 metros y diámetros de hasta 145cm de DAP (Diámetro a la altura de pecho). Véase figura 21. Según una nota técnica2 sobre el mango “Los árboles en su madurez crecen típicamente a una altura de 25 m o más, con troncos principales de hasta 15 m y diámetros a la altura del pecho (D.A.P.) de entre 0.6 y 2.0 m”.---
En la presente causa se ejecuta la sentencia Nº 11-2019-IV de las 08:15 horas del 25 de febrero de 2019, dictada por la Sección IV del Tribunal Contencioso Administrativo, -que en lo medular- dispuso: “POR TANTO (...) (VÉANSE DISPOSICIONES ANULATORIAS punto i) a x)." En esta misma tesitura, la sentencia de rito establece una serie de CONDENAS INDEMNIZATORIAS Y/O REPARACIONES, según detalle: "[...] xi) Se condena, en abstracto, a las empresas Punta Dominical S.A., Empresa Hotelera Dominical S.A. y Empresa Dieciocho Veintiuno S.A., al pago de los daños y perjuicios ocasionados al ambiente y al Patrimonio Natural del Estado, en virtud de sus actuaciones ilegítimas en relación con los terrenos de la zona marítimo-terrestre de Punta Dominical, cuya existencia y cuantía se establecerán en la fase ejecución de sentencia. xii) Se condena, en abstracto, a las Administraciones contrademandadas, al pago de los daños y perjuicios generados a partir de las conductas administrativas activas u omisivas, que han causado lesión al Patrimonio Natural del Estado y al ambiente en los terrenos objeto de este proceso, cuya existencia y cuantía se establecerán en la fase ejecución de sentencia. xiii) Se declara responsables a las Administraciones contrademanadas, por la omisión ilegítima en el ejercicio oportuno y adecuado de las atribuciones conferidas por el ordenamiento jurídico, para lograr la revocación o anulación de las conductas administrativas objeto de este proceso y la tutela efectiva de los terrenos de la Zona Marítimo Terrestre involucrados en este litigio. xiv) Se ordena a las empresas y Administraciones contrademandadas, abstenerse de incurrir en conductas activas u omisivas que lesionen el Patrimonio Natural del Estado y el ambiente en los terrenos de la zona marítimo-terrestre comprendidos dentro del Plan Regulador Costero de Punta Dominical. xv) Respecto de la demanda, se condena al pago de ambas costas a Empresa Hotelera Dominical S.A. y Punta Dominical S.A, a favor del Estado, la Contraloría General de la República y el Sistema Nacional de Áreas de Conservación, junto con los respectivos intereses legales, que se computarán a partir de la firmeza de la resolución mediante la cual se determine el quantum de las mismas y hasta su efectivo pago.
En lo atinente a la contrademanda, se condena a Empresa Hotelera Dominical S.A., Punta Dominical S.A, Dieciocho Veintiuno S.A., Municipalidad de Osa, INVU e ICT, al pago de ambas costas a favor de la Contraloría General de la República junto con sus respectivos intereses legales, que se computarán a partir de la firmeza de la resolución mediante la cual se determine el quantum de las mismas y hasta su efectivo pago.”.- En este orden se tienen por reconocidos los extremos de: A.- pago de los daños y perjuicios ocasionados al ambiente y al Patrimonio Natural del Estado, B.- pago de los daños y perjuicios generados a partir de las conductas administrativas activas u omisivas, que han causado lesión al Patrimonio Natural del Estado y al ambiente en los terrenos objeto de este proceso, cuya existencia y cuantía se establecerán en la fase ejecución de sentencia. C.- Se ordena a las empresas y Administraciones contrademandadas, abstenerse de incurrir en conductas activas u omisivas que lesionen el Patrimonio Natural del Estado y el ambiente en los terrenos de la zona marítimo-terrestre comprendidos dentro del Plan Regulador Costero de Punta Dominical.
D.- Respecto de la demanda, se condena al pago de ambas costas a Empresa Hotelera Dominical S.A. y Punta Dominical S.A, a favor del Estado, la Contraloría General de la República y el Sistema Nacional de Áreas de Conservación, junto con los respectivos intereses legales, que se computarán a partir de la firmeza de la resolución mediante la cual se determine el quantum de las mismas y hasta su efectivo pago. E.- En lo atinente a la contrademanda, se condena a Empresa Hotelera Dominical S.A., Punta Dominical S.A, Dieciocho Veintiuno S.A., Municipalidad de Osa, INVU e ICT, al pago de ambas costas a favor de la Contraloría General de la República junto con sus respectivos intereses legales, que se computarán a partir de la firmeza de la resolución mediante la cual se determine el quantum de las mismas y hasta su efectivo pago.--- En este sentido, la Contraloría peticiona en su escrito inicial de la ejecución lo siguiente: 1.
Requerir a la Municipalidad de Osa, al INVU y al ICT que informen sobre las actuaciones que han sido ejecutadas en cumplimiento a lo dispuesto por el TCA mediante la resolución de fondo n.° 11-2019-IV. // 2.- Se declare la responsabilidad solidaria de las empresas Punta Dominical S.A., Empresa Hotelera Dominical S.A., Empresa Dieciocho Veintiuno S.A., así como de las dependencias públicas contrademandadas, sea el Instituto Costarricense de Turismo, el Instituto Nacional de Vivienda y Urbanismo y la Municipalidad de Osa y, en consecuencia, que ordene la cancelación de ¢33.755.969,00, monto que corresponde al daño ambiental generado producto de sus actuaciones y/u omisiones.-- 3. Se ordene como medida de aseguramiento la paralización, de forma inmediata, de cualquier obra actual o futura que se esté desarrollando en el sector del Restaurante “La Parcela” en Dominicalito de Osa. Y para tal efecto, se disponga al SINAC y a la Municipalidad de Osa verificar el cumplimiento de lo dispuesto por el Tribunal y se proceda a informar lo que corresponda. 4.
Que se apruebe la liquidación de costas personales a favor de la Contraloría General de la República, más los intereses respectivos hasta su efectivo pago, de la forma en que se detalla a continuación:
Posteriormente en su escrito de conclusiones, ratifica la pretensión de aprobar las liquidaciones por daño ambiental, la declaración de responsabilidad solidaria, la liquidación de costas más los intereses legales, mantener los embargos preventivos, la petición de medida de aseguramiento y la gestión de prevención de desalojo, y Municipalidad de Osa que remita de forma inmediata al ICT y al INVU, la totalidad de la información técnica requerida para materializar la actualización y rectificación del Plan Regulador Costero de Punta Dominical.--- Por su parte, la Procuraduría peticiona aprobar la fijación de costas personales en favor del Estado contra Empresa Hotelera Dominical S.A. y Punta Dominical S.A. por la suma de seis millones de colones (₵6.000.000,oo), así como conceder los intereses que se generen hasta su efectivo pago, conforme se ordenó en la sentencia n.° 11-2019-IV.--- Y en su escrito de conclusiones ratifica esa pretensión y adiciona que se prevenga su desalojo inmediato y se comisione al Área de Conservación de Osa para que verifique su cumplimiento, con el auxilio de la Fuerza Pública de ser necesario, recordando que los numerales 156 y 157 de la Ley 8508 otorgan el Juez ejecutor los poderes necesarios para la plena efectividad y eficacia de lo ordenado en sentencia.--- Se procede a analizar cada uno de los extremos: A.- DEL DAÑO AMBIENTAL: 1.- SOBRE LA VALORACIÓN ECONÓMICA DEL DAÑO AMBIENTAL (VEDA).
Tanto la Contraloría como el SINAC, aportaron el VEDA y ofrecieron a la Inga. Valverde como testigo/perito para referirse a dicho informe que arribó a los siguientes conclusiones: "[...] Asimismo y luego de explicar la metodología utilizada, así como los indicadores económicos que fueron parte del estudio, se hizo un análisis de los resultados obtenidos, señalando que: ● Se establece que para el recurso vegetación el valor económico es de ¢17.290.0252,60 donde se incluye el valor del costo del bosque eliminado, carbono y oxígeno. ● En cuanto a la estimación de la pérdida del valor paisajístico, se estima que hubo una pérdida económica de ¢7.627.963,05. Es un valor elevado, ya que es un área declarada como Patrimonio Natural del Estado, áreas que deberían destinarse a la protección de los recursos naturales. ● Por concepto de gastos administrativos se obtuvo un valor de ¢212.698,64, donde se consideró el trabajo realizado tanto del levantamiento preliminar donde se describieron los daños encontrados, el seguimiento al caso, la elaboración de la VEDA, además de cuantificar la participación de todos los funcionarios del SINAC-ACOSA que atendieron el caso.
Así, en dicho informe se estableció que la estimación de la valoración económica del daño ambiental causado en el sector del Restaurante “La Parcela” en Dominicalito de Osa asciende a ¢25.130.914,29, monto que fue ajustado el 27 de febrero de 2024 a través del informe n.° SINAC-ACOSA-DT-PNE-Inf-008-2024, elaborado por la Licda. Valverde Gamboa, indicando: "Debido a error material en informe SINAC-ACOSA-DT-PNE-Inf-007-2024 no se incluyeron dentro de la Valoración del daño los costos por concepto de demolición y costos de restauración del sitio.”, los cuales cuales fueron precisados de la siguiente manera: ● Se establece que para el costo de demolición de las obras el valor económico es de ¢2.772.077,00. Se realiza la estimación de cuánto podría costar demoler las obras construidas, generando actividades de contratación de mano de obra, transporte de materiales, alquiler de maquinaria, y la contratación de un ingeniero que fiscalice el proyecto. ● En cuanto a la estimación del costo de restauración del sitio, se estima un valor de ¢5.852.978,00. donde se cuantifican los costos por concepto de compra de árboles forestales, transporte, preparación del terreno y siembra de árboles (limpieza, trazado, demarcación, hoyado y siembra), mantenimiento, control y protección y la regencia mediante un ingeniero forestal.
El total estimado para estos dos nuevos indicadores es de ¢8.625.055. Así las cosas, el VALOR TOTAL estimado correspondiente a la valoración económica del daño ambiental (VEDA) en la zona de “La Parcela” en Dominicalito de Osa es de ¢33.755.969,00, [...]".--- Durante la audiencia oral de ejecución se evacuó a dicha testigo/perito que respondió -en lo medular-, ante las preguntas de la Contraloría que es licenciada en ingeniería forestal, que trabaja en el Área de Zonas Silvestres Protegidas, que trabajó en el Departamento de Patrimonio Natural del Estado. Sobre las acciones realizadas expone que analizó la sentencia, trabajó con el Departamento de Patrimonio Natural del Estado para acceder al expediente, que realizó una visita al campo junto con un funcionario topógrafo, que realizó trabajo de gabinete, y rindió el informe. Expone que el área coincide con el mapa B1, se ubica por coordenadas, georeferenciadas, que se encontraron elementos físicos, identifica el Restaurante La Parcela, zona de parqueo que tiene suelo con piedras, cuatro cabañas, área de lavandería, con un total de nueve características constructivas.
Refiere a las imágenes contenidas en la im. 249 del legajo, relativo a árboles con hojas y ramas, con trabajos recientes, donde se evidencia los tocones (resto de fuste) por tala de árboles. Desarrolla los instrumentos utilizados, aborda los cuatro tipos de metodología oficiales que utiliza el SINAC para sus estudios, que han sido validadas por expertos, tales como el Instituto de Políticas Sostenibles así como el método de Alfredo Zeledón. Explica los indicadores como carbono, oxígeno, valor del paisaje, costo de restauración (costos de demolición). Apunta que e el sitio hay árboles de mango que pueden ser parte del ecosistema. Por otro lado, sobre las consultas del SINAC responde que lo solicitado fue realizar una valoración del daño ambiental, utilizó el método de Alfredo Zeledón para cuantificar el daño ambiental, en bosque más el método del Instituto para la matriz de restauración. Aclara que no es posible estimar daños ambientales sin una metodología, para evaluar la técnica y la ciencia sobre criterios de expertos, bibliografía y otros.
Que utilizó variables que se desprenden de la metodología, como área afectada, elementos afectados, con imágenes que deben ser georeferenciadas, y que las fuentes sean confiables, para lo que se requiere análisis espacial in-sito, con fuentes del Instituto Geográfico Nacional, que permitan una regresión, así como las fuentes del SINAC sobre cobertura forestal. Advierte que las imágenes tomadas en Google Maps son fuentes secundarias, que no tienen precisión. Aborda el procedimiento sobre el área declarada como bosque según la normativa de la Ley Forestal, que cumple con los parámetros técnicos, de acuerdo a la metodología diseñada por la Universidad Nacional, con análisis cuantitativos y cualitativos de bosque, se debe realizar por medio de parcelas, estableciendo número de árboles, altura, cobertura, diferentes especies, cantidad por hectáreas. Señala que establecer parcelas es un trabajo de gabinete, y que no se puede llegar a la conclusión de bosque sin hacer parcelas.--- Relativo a las preguntas de la Procuraduría aborda el informe 6, imagen 3,d) sobre el área de parqueo, la cantidad de vehículos estacionados, y que el fin del mismo es de parqueo para los carros de los turistas de van al restaurante.
Aborda el área de 2.900 mtrs que es el polígono delimitado, que la distancia entre las cabañas y el restaurante están en el bosque, que los árboles de mango se encuentran en línea, no precisa la cantidad exacta de árboles, que podría representar un 15% y explica el mapa 1 d de la imagen 210 del legajo y las diferentes zonas. Cierra manifestando que la norma que autoriza estos estudios deviene de la competencias del SINAC, por su veracidad y ética, con el uso de fuentes autorizadas y competentes.- Por otro lado, ante las preguntas del ICT indica que hay trabajos recientes puesto que identifican a personas trabajando, con materiales como piedra, postes, se ve una estructura inconclusa, con una construcción quizá de meses, que esas obras son posteriores a la sentencia de 2019, que no la incluyó dentro del daño, y no lo cuantifica, y lo que hizo fue reportarlo a la Contraloría.-- Referente a las consultas de la Municipalidad de Osa respondió que para determinar un ecosistema con bosque es necesario hacer parcelas de muestre, que se hicieron en el informe ACOSA 2008, que no se realizó para este informe un levantamiento forestal de especies, que se partió del informe del año 2008, misma que esta generaren y que en este caso no se hace necesario por ser un área impactada.
Insiste que hay construcciones de varios años atrás, que no puede precisar de cuanto datan, pero que más bien puede confirmar una invasión. Que el mapa 1, lo realizó el topógrafo y también se utiliza Google Maps, y que sobre los árboles de mango no tiene datos pero que podría ser de más de 50 años.--- Acerca de las preguntas del representante de las empresas actoras/vencidas responde que su superior es la Directora del Área Silvestre de Osa, que cuando rindió el informe se encontraba asignada al Área de Patrimonio Natural del estado, que estudió economía forestal como parte de las asignaturas de su carrera, y que ha recibido otras capacitaciones adicionales. Ante la consulta de por qué no denunció las supuestas obras recientes, manifestó que se rindió cuentas a la Contraloría General, que desconoce si las obras son reparaciones o mejoras, que calcula que los árboles cortados fueron entre 3 o 4.
Detalla la metodología para el cálculo del daño y reparación, que no es sobre la cantidad de árboles cortados, se obtiene por estimación de las parcelas colindantes, la cantidad de biomasa que generan, que se convierte en carbono/oxígeno, también el valor paisajístico, las áreas de valor turístico, la cuantificación de la belleza escénica, aspectos que se aborda en el informe SINAC-ACOSA-DT-PNE-007-2024.--- Las partes reconventoras/ejecutantes en sus escritos de conclusiones afirmaron, por un lado, la Contraría apuntó que Sobre la Valoración Económica del Daño Ambiental (VEDA). Solicita de manera expresa que se otorgue pleno valor probatorio, a la secuencia de informes técnicos incorporados al legajo de ejecución, los informes SINAC-ACOSA-DT-PNE-006-[007]-[008]-2024, y CARTA-SINAC-ACOSA-DT-124-2025.- Menciona que el SINAC, en su condición de órgano especializado del Ministerio de Ambiente y Energía, ostenta por mandato legal expreso la condición de Administración Forestal del Estado, siendo la autoridad técnica legalmente investida y competente para actuar como perito evaluador oficial en los procesos de cuantificación de daños contra los recursos naturales públicos, según se deriva del artículo 58 de la Ley Forestal n.° 7575.
Que los informes rendidos por dicha autoridad técnica en la materia no constituyen opiniones subjetivas, sino que gozan de dos cualidades fundamentales: 1) la objetividad técnica y 2) la completez y exhaustividad de los hallazgos de campo, que en en la elaboración de su informe utilizó metodologías científicas, como son los lineamientos del Instituto de Políticas para la Sostenibilidad y las directrices técnico-ambientales del oficio n.° SINAC-DE-2024-2021, es decir, se utilizaron parámetros objetivos con respaldo legal y científico y aplicables -justamente- a este tipo de valoraciones económicas. Además expone que los funcionarios del SINAC realizaron un levantamiento físico de precisión el día 26 de enero de 2024, empleando receptores GNSS Spectra Geospatial SP85 y GPS Garmin, determinando una huella de afectación constructiva consolidada y homogénea de 2.970 m². Este estudio no se limitó a medir infraestructuras estáticas, sino que documentó, mediante un riguroso archivo fotográfico, alteraciones físicas contemporáneas y flagrantes, tales como la corta reciente de árboles, la remoción de vegetación nativa para la construcción no autorizada de un nuevo mirador en las coordenadas georreferenciadas N 1019727 y E 517176, y modificaciones no autorizadas en los senderos.- También adjunta el desglose pericial definitivo estructurado en el Informe n.° SINAC-ACOSA-DT-PNE-Inf-008-2024, el cual precisó los rubros materiales indispensables de demolición y restauración biofísica, arrojando el quántum del daño ambiental.-- En esta tesitura, por su parte, el SINAC indicó que Sobre Uso de metodologías científicas y oficiales vs. Criterios subjetivos ("Fuentes propias") El aspecto más crítico de una Valoración Económica de Daño Ambiental (VEDA) es el método empleado para llegar a sus conclusiones, ya que la Ing. Daniela fundamentó su peritaje en metodologías científicas y oficiales, específicamente la metodología de Don Alfredo Zeledón y la Metodología para la valoración económica del daño ambiental del Instituto Políticas para la Sostenibilidad (IPS), oficializadas mediante el oficio SINAC-DE-2024-2021.
Esto garantiza un procedimiento comprobado y aceptado para cuantificar la pérdida de ecosistemas, fijación de carbono, oxígeno y valor paisajístico tal como lo explico abundante la ingeniera Valverde, en tanto que, por el contrario, [...]".-- Sobre la Precisión técnica y georreferenciación vs. Imágenes no oficiales sin simbología. El SINAC apunta que la georreferenciación es fundamental en un estudio de daño ambiental porque permite ubicar y delimitar técnicamente el área afectada, que la Ing. Valverde identificó las áreas mediante georeferenciación y trabajo de campo que incluyo el levantamiento de la infraestructura y su ubicación geoespacial pero el rollo fotográfico aportado por Vargas carece de coordenadas y de simbología, al punto de que, al ser interrogado en audiencia, fue incapaz de precisar la ubicación exacta de las construcciones que señalaba y al ser imágenes sin georeferenciación tampoco se puede tener certeza que sean imágenes que pertenezcan al sitio afectado. [...] En consecuencia, no solo se advierte una ausencia de aplicación de metodologías científicas y técnicas objetivas, sino también una valoración incompleta de los antecedentes documentales disponibles, circunstancia que inevitablemente compromete la solidez y confiabilidad de las conclusiones alcanzadas por el perito.
Advierte que la certificación emitida por el SINAC en el año 2008 no constituyó el nacimiento de la condición de Patrimonio Natural del Estado del inmueble en cuestión, sino la constatación administrativa de una realidad jurídica preexistente, sustentada tanto en la normativa forestal vigente como en la continuidad histórica del régimen de protección que, desde las primeras leyes forestales de la República (año 1969), ha recaído sobre los terrenos forestales pertenecientes al Estado.-- En sentido contrario, las partes reconvenidas/vencidas cuestionaron, por parte de la representación de las empresas que Sobre los daños y perjuicios reclamados. Expresó que se oponen a los informes sobre valoración de daño ambiental realizados por SINAC, por resultar una parte con intereses dentro del presente proceso y por carecer de elementos sustanciales mínimos para establecimiento de un daño, así como a que hacen referencia a construcciones ilegales, o ampliaciones a las construcciones ya existentes, pues resultan completamente lejanas a la realidad, que no hacen referencia al estado anterior de las edificaciones, para así, sobre una base comparativa sólida, se pueda concluir sobre la construcción de nuevas obras, se reprochan las manifestaciones realizadas en torno a una supuesta corta de árboles, que dan como resultado una estimación de varios millones, producto de esa infundada referencia a corta.
Apunta que se extraña, al menos una mención general de las características de ese daño, mismas comprendidas en el numeral 196 de la Ley General de la Administración Pública. Dados los cuestionamientos al informe del SINAC, tales como que los informes de SINAC corresponden a un levantamiento de campo, en el cual funcionarios del SINAC midieron cabinas, senderos, caminos, parqueo, lavandería, entrada y restaurante, concluyendo que existe un área total de afectación de 2.970 m2 y que el terreno ha sido sometido a cambio de uso del suelo, pasando de bosque a áreas ocupadas para uso turístico. Sin embargo, ese documento mide superficies ocupadas, pero no demuestra de forma suficiente la relación causal entre cada uno de esos espacios y un daño ambiental reciente, actual y jurídicamente imputable dentro del marco temporal relevante para esta ejecución. No diferencia adecuadamente cuáles obras son antiguas, cuáles serían recientes y cuáles preexistían a la fecha base pertinente.
Que el informe 007-2024 fija una valoración económica del daño ambiental en 25.130.914,29 colones, integrando rubros de bosque eliminado, carbono, oxígeno, valor paisajístico y gastos administrativos. La objeción central es que esa cuantificación descansa sobre supuestos no demostrados suficientemente en el informe antecedente. También apunta que la metodología utilizada —basada en la metodología de Alfredo Zeledón adaptada por SINAC— opera en el caso concreto como un sistema abstracto de valorización que no termina de ajustarse a la realidad histórica y biofísica específica del sitio. El informe usa indicadores y fuentes heterogéneas en el tiempo, incluidos precios de oxígeno de 2010, referencias de carbono de otra literatura y valores ecosistémicos provenientes de estudios generales, sin justificar adecuadamente su pertinencia singular para Dominicalito. También existe un problema de homogeneización indebida del área afectada.
El informe trata prácticamente los 2.970 m2 como si constituyeran un bloque uniforme de bosque eliminado, pese a que en el sitio coexisten componentes construidos, áreas de parqueo, senderos y presencia de especies introducidas y nativas, además de intervenciones recientes puntuales y estructuras antiguas.-- Finalmente señaló que por haber sido emitido por una parte con interés directo en el resultado de este proceso, con pretensiones propias, solicita descartar la eficacia probatoria de los informes SINACACOSA-DT-PNE-Inf-006-2024, SINAC-ACOSA-DT-PNE-Inf-007-2024 y SINAC-ACOSADT-PNE-Inf-008-2024, por sus deficiencias metodológicas.--- 2.- INFORME PERICIAL DEL ING. VARGAS ARIAS. La parte actora/vencida, sean las empresas, solicitó se designara un perito judicial, en donde el Ing. Vargas en su informe concluye: [...] "Conclusiones:
Es oportuno advertir, que las objeciones planteadas por las partes vencidas, relativas a la estimación de los daños y prejuicios reclamados, por ser realizados por SINAC, resultando una parte con intereses dentro del presente proceso y por carecer de elementos sustanciales mínimos para establecimiento de un daño, no es de recibo, puesto que el marco normativo establece como órgano técnico científico encargado del Patrimonio Natural de El Estado, precisamente a dicha institución, sus informes son rendidos en el marco de su competencia, derivan de sus obligaciones legales, y su labor se enmarca en la protección constitucional y legal del medio ambiente, como derecho humano fundamental, por lo que no le cobija un interés de beneficio o enriquecimiento institucional o propio.- Estima este juzgador que los informes de marras, así como la declaración de la testigo/perito desarrollan ampliamente, de forma precisa, concreta y detallada de los daños ambientales ocasionados por las partes vencidas, conforme al numeral 196 de la Ley General de la Administración Pública.- Deben recordar las partes que la determinación del daño -aún en forma abstracta- por parte del Tribunal de Juicio, así como la relación causal entre cada uno de esos espacios y un daño ambiental reciente, actual y jurídicamente imputable ya son asuntos revestidos de cosa juzgada y por ende precluidos, y no es la fase de ejecución una reapertura ni repetición de los alegatos de fondo.
Ahora bien, relativo a los cuestionamientos sobre el informe 007-2024 que fija una valoración económica del daño ambiental en 25.130.914,29 colones, integrando rubros de bosque eliminado, carbono, oxígeno, valor paisajístico y gastos administrativos, no resulta procedente, en tanto, se valoran supuestos técnico/científicos aceptados según las reglas normativas vigentes; así como el uso de indicadores y fuentes en el tiempo, incluidos precios de oxígeno de 2010, referencias de carbono y valores ecosistémicos provenientes de estudios generales, que no lograron ser desvirtuados en forma técnica por la parte vencida, por lo que se deben rechazar dichas objeciones.- En consecuencia, sobre los daños ambientales se debe reconocer los resultados de la valoración económica del daño ambiental (VEDA) en la zona de “La Parcela” en Dominicalito de Osa que, comprenden el costo por bosque eliminado, el carbono, y el oxígeno, el costo paisajístico, gastos de administración, costos de demolición y de restauración, para palear, mitigar y restaurar el medio ambiente afectado, se fijan en la suma de ¢33.755.969,00, tal y como se describe en el siguiente cuadro:
B.- DE LA RESPONSABILIDAD SOLIDARIA. La sentencia que se ejecuta dispone: "[...] xv) Respecto de la demanda, se condena al pago de ambas costas a Empresa Hotelera Dominical S.A. y Punta Dominical S.A, a favor del Estado, la Contraloría General de la República y el Sistema Nacional de Áreas de Conservación, junto con los respectivos intereses legales, que se computarán a partir de la firmeza de la resolución mediante la cual se determine el quantum de las mismas y hasta su efectivo pago. En lo atinente a la contrademanda, se condena a Empresa Hotelera Dominical S.A., Punta Dominical S.A, Dieciocho Veintiuno S.A., Municipalidad de Osa, INVU e ICT, al pago de ambas costas a favor de la Contraloría General de la República junto con sus respectivos intereses legales, que se computarán a partir de la firmeza de la resolución mediante la cual se determine el quantum de las mismas y hasta su efectivo pago. [...]".- La Contraloría en su escrito de ejecución peticiona que: "4. Que se apruebe la liquidación de costas personales a favor de la Contraloría General de la República, más los intereses respectivos hasta su efectivo pago, de la forma en que se detalla a continuación:
La Procuraduría, por otro lado, peticiona aprobar la fijación de costas personales en favor del Estado contra Empresa Hotelera Dominical S.A. y Punta Dominical S.A. por la suma de seis millones de colones (₵6.000.000,oo), así como conceder los intereses que se generen hasta su efectivo pago, conforme se ordenó en la sentencia n.° 11-2019-IV.- Se aprecia que tanto en la sentencia de fondo, como en las pretensiones de reparación de daños como las liquidaciones, no se establece un porcentaje o medida diferente para cada una de las partes vencidas, por lo que se debe entender que la responsabilidad es solidaria entre las referidas partes vencidas. En acopio a lo anterior, debe tenerse presente que este juzgador coincide con la representación estatal en el sentido que la responsabilidad ambiental además de ser objetiva, es solidaria, que no requiere demostrarse la culpa o negligencia, y que se asume ese riesgo como consecuencia dañosa para el ambiente y se puede dirigir contra los representantes legales de las personas jurídicas e instituciones involucradas en las conductas impugnadas, según lo establece los artículos 28 y 50 constitucionales; así como la normativa de la Ley N° 7554 en sus ordinales 2, 98, 99, 101, 109; la Ley N° 7788 en el artículo 109; y los votos 1669-2000, 6514-2002, 4822-2007 y 6613-2007, todos de la Sala Constitucional de la Corte Suprema de Justicia, en consecuencia, el monto económico impuesto en este fallo por daño ambiental, es solidario, a Punta Dominical S.A., Empresa Hotelera Dominical S.A., Empresa Dieciocho Veintiuno S.A, INVU, ICT y Municipalidad de Osa.---
1.- DE LAS MEDIDAS DE ASEGURAMIENTO: La Contraloría solicitó en su escrito de pretensiones que: "[...] Se ordene como medida de aseguramiento la paralización, de forma inmediata, de cualquier obra actual o futura que se esté desarrollando en el sector del Restaurante “La Parcela” en Dominicalito de Osa. Y para tal efecto, se disponga al SINAC y a la Municipalidad de Osa verificar el cumplimiento de lo dispuesto por el Tribunal y se proceda a informar lo que corresponda.[...]". Ahora bien se tiene que la sentencia N° 11-2019-IV, de la Sección Cuarta de este Tribunal, y que es objeto de la presente ejecución, dispuso en lo conducente: "viii) Se declare que en el caso de las áreas clasificadas como Patrimonio Natural del Estado en los terrenos descritos en los planos catastrados número: P-863801-2003, P-863803-2003, P-864164-2003, P-865511-2003, P-882230-2003, P-864163-2003, P-883689-2003 y las que se ubican en los terrenos con solicitud de concesión que se tramita en la Municipalidad de Osa bajo el expediente que se aporta con certificación No. 629-2009, así como en el área de la zona pública, donde actualmente se ubican las instalaciones del restaurante y cabinas denominado “La Parcela”, su administración corresponde en forma exclusiva al Ministerio de Ambiente y Energía a través del Sistema Nacional de Áreas de Conservación.- En esta tesitura queda debidamente acreditado para este juzgador, que de acuerdo a los informes presentados por el SINAC, así como la declaración de la testigo/perito durante la audiencia oral de ejecución, se evidencia corta de árboles, con tocones visibles debajo de una plataforma de concreto, en la construcción de una estructura semejante a una pérgola, por lo que se continúan realizando modificaciones a las áreas dentro de la zona de Patrimonio Natural de El Estado.- En consecuencia, al tenor del ordinal 50 de la Constitución Política, así como la Ley Forestal N° 7575, el voto 1763-94, 778-08 de la jurisprudencia de la Sala Constitucional, que establecen los principios precuatorio, reparador, de protección al medio ambiente, así como la Ley Forestal N° 7575, Ley de Biodiversidad N° 7788, Ley de Conservación de la Vida Silvestre N° 7317, que le imponen al MINAE a través del SINAC, una serie de deberes y obligaciones, en el marco de su competencia, en materia de ambiental, así como el principio de intangibilidad de la cosa juzgada y tutela judicial efectiva, este juzgador con fundamento en los numerales 155 y 156 del CPCA, que otorga todos los poderes y deberes necesarios para la efectividad y eficacia de la sentencia, y le faculta a dictar las medidas adecuadas y necesarias para su debida ejecución, dispone acoger la solicitud y se debe ordenar como medida de aseguramiento la paralización, de forma inmediata, de cualquier obra actual o futura que se esté desarrollando en el sector del Restaurante “La Parcela” en Dominicalito de Osa, para lo cual se dispone que el SINAC y a la Municipalidad de Osa, colaborando con dicha institución, verifiquen el cumplimiento de lo dispuesto por el Tribunal, tomando las acciones de clausura y/o derivo, y se proceda a informar en el plazo de 5 días hábiles lo que corresponda, y así se dicta.-- 2.- DE LA ACTUALIZACIÓN DEL PLAN REGULADOR COSTERO.
La Contraloría solicitó en su escrito de pretensiones que: "[...] 1. Requerir a la Municipalidad de Osa, al INVU y al ICT que informen sobre las actuaciones que han sido ejecutadas en cumplimiento a lo dispuesto por el TCA mediante la resolución de fondo n.° 11-2019-IV.[...]". Ahora bien, se tiene que la sentencia N° 11-2019-IV, de la Sección Cuarta de este Tribunal, y que es objeto de la presente ejecución, dispuso en lo conducente: "vii) Se ordena a la Municipalidad de Osa, al ICT y al INVU, proceder de inmediato a realizar los ajustes necesarios al Plan Regulador Costero de Punta Dominical, excluyendo de dicha planificación las áreas clasificadas como Patrimonio Natural del Estado en los planos antes citados y las que cuentan con declaratoria no turística por parte del ICT, conforme a la descripción indicada. Lo antes dicho deberá estar concluido y aprobado en un plazo no mayor de un año, contado a partir de la firmeza de esta sentencia..".-- En esta tesitura quedo debidamente acreditado para este juzgador, que tanto el ICT como la Municipalidad de Osa, informaron de los acuerdos tomados por la Junta Directiva del Instituto, así como de los acuerdos del Concejo Municipal, sobre las anulaciones de permisos, concesiones y otros.
Sin embargo, no hay evidencia que acredite que en el plazo dispuesto por la sentencia de fondo se haya realizado el ajuste necesario al Plan Regulador Costero de Punta Dominical, por lo que se constituye en un incumplimiento. En consecuencia, también al tenor del ordinal 50 de la Constitución Política, así como la Ley Forestal N° 7575, el voto 1763-94, 778-08 de la jurisprudencia de la Sala Constitucional, así como la Ley de Planificación Urbana N° 4240, la Ley Orgánica del INVU N° 1788, la Ley Orgánica del ICT N° 1917, y el Código Municipal Ley N° 7794, que les impone una serie de deberes y obligaciones, en el marco de su competencia, en materia de regulación urbana, así como el principio de intangibilidad de la cosa juzgada y tutela judicial efectiva, este juzgador con fundamento en los numerales 155 y 156 del CPCA, que otorga todos los poderes y deberes necesarios para la efectividad y eficacia de la sentencia, y le faculta a dictar las medidas adecuadas y necesarias para su debida ejecución, dispone acoger la solicitud, y por ende, se debe ordenar que se informe, en el plazo de 5 días hábiles, por parte de la Municipalidad de Osa, al ICT y al INVU, sobre los ajustes necesarios al Plan Regulador Costero de Punta Dominical.--- 3.- DEL DESALOJO INMEDIATO DEL INMUEBLE: En la especie se tiene que por escrito de 13 de enero de 2026, las empresas solicitan intervención ante orden de desalojo inmediato emitida por parte de la Municipalidad de Osa, que por auto de las dieciocho horas veinticuatro minutos del dieciséis de enero de dos mil veintiséis se confiere audiencia urgente a la Municipalidad sobre orden de desalojo, y en esa tesitura, por escrito de 19 de enero de 2026, la Contraloría y la Procuraduría, cada una por su parte, se refieren a la orden de desalojo.
Posteriormente, por escrito de 20 de enero de 2026, la Municipalidad informa que la orden de desalojo ha sido suspendida. Este aspecto nuevamente es abordado durante la audiencia oral de ejecución, y en sus escritos de conclusiones ambas entidades refieren a dicha gestión, particularmente se solicita: "6. Ordenar la ejecución inmediata del desalojo definitivo y la demolición total de la totalidad de las infraestructuras, cabinas y edificaciones comerciales levantadas de forma ilegal en el sector de "La Parcela", disponiendo expresamente que dicha demolición material debe ser realizada por la Municipalidad de Osa, bajo la supervisión técnica del SINAC en lo de su competencia.".--- Ahora bien, se tiene que la sentencia N° 11-2019-IV, de la Sección Cuarta de este Tribunal, y que es objeto de la presente ejecución, dispuso en lo conducente: "[...] ix) Se declara ilegítima la ocupación ejercida por la Empresa Hotelera Dominical S.A., sobre los terrenos de la zona pública de Punta Dominical, en el sitio donde actualmente se localiza el restaurante y cabinas denominado “La Parcela”, así como las construcciones que albergan ese negocio, por lo que se ordena el desalojo y la desocupación definitiva de esa área objeto de la ilegal autorización para la aplicación del artículo 21 de la Ley No. 6043, otorgada por el ICT y la Municipalidad de Osa.".--- En esta tesitura quedo debidamente acreditado para este juzgador, con base en los informes del SINAC, así como la declaración del perito judicial como de la testigo/perito que hasta el momento de la audiencia oral de ejecución, el restaurante, el parqueo, las cabinas y demás construcciones que albergan el negocio continúan en funcionamiento, sin que se haya hecho efectivo el desalojo y desocupación definitiva como lo ordenó la sentencia de rito, evidenciándose un incumplimiento.
En consecuencia, también al tenor del ordinal 50 de la Constitución Política, así como la Ley Forestal N° 7575, el voto 1763-94, 778-08 de la jurisprudencia de la Sala Constitucional, así como la Ley de Planificación Urbana N° 4240, y el Código Municipal Ley N° 7794, que les impone una serie de deberes y obligaciones, en el marco de su competencia, en materia de regulación urbana, así como el principio de intangibilidad de la cosa juzgada y tutela judicial efectiva, este juzgador con fundamento en los numerales 155 y 156 del CPCA, que otorga todos los poderes y deberes necesarios para la efectividad y eficacia de la sentencia, y le faculta a dictar las medidas adecuadas y necesarias para su debida ejecución, dispone acoger la solicitud, y por ende, se debe ordenar que en el plazo de quince días naturales, las empresas actoras/vencidas procedan con el desalojo voluntario del restaurante, el parqueo, las cabinas y demás construcciones que albergan el negocio, so pena, de que si no lo ejecuten en dicho plazo, se proceda con el desalojo definitivo y la demolición total de la totalidad de las infraestructuras, cabinas y edificaciones comerciales levantadas en el sector de "La Parcela", para lo que se comisiona a la Municipalidad de Osa para el desalojo y la demolición material, bajo la supervisión técnica del SINAC, en lo de su competencia, para evitar nuevos daños ambientales, y así se debe dictar.---
Sobre la liquidación de costas. Apunta que reitera la suma de ₡11.000.000,00 detallada en el escrito de ejecución por concepto de costas personales de la demanda, la contrademanda, el recurso de casación y la presente fase de ejecución, y refiere a la extensión temporal excepcional y la complejidad del litigio, y al trabajo desplegado.-- Por su parte, El Estado apunta que el 22 de abril de 2024, con amplitud de justificación, la personera del Estado las estimó en 6 millones de colones, y que la contraparte, en sus conclusiones, no las objetó.-- En sentido contrario, las empresas apuntan que Sobre las costas pretendidas. Se opone a las pretensiones estimatorias sobre el pago de costas, pues amén de no indicar porcentualmente, cuáles montos debería concluir cada parte, carecen de un sustento técnico, fundado al menos en el Decreto de Aranceles del Colegio de Abogados, que permitan concluir en el fundamento jurídicos de esos cobros, que es excesivo, desproporcionado.-- Por otro lado, el ICT peticiona que en cuanto a costas, resolver con apego a criterios de prudencia y razonabilidad, conforme a los montos objetados en su gestión anterior.-- Y la Municipalidad de Osa expresa que sobre las costas pretendidas: que es necesario indicar que sobre el rubro de Costas Personales, el órgano Contralor debió haberse sujetado a los límites que señala el arancel de abogados vigente para la fecha en que se interpuso la contrademanda, la cual data del año 2009, estando vigente para ese momento el Arancel de Honorarios por Servicios de Abogacía y Notariado que era Decreto Ejecutivo #32493-J publicado en la Gaceta #150 del 05 de agosto de 2005 y su reforma que es Decreto Ejecutivo #34442 de 17 de diciembre de 2007 que no sustituyó integralmente el arancel vigente en el decreto anteriormente indicado.
De los montos expuestos en este apartado en el escrito de Ejecución de la contrademandante NO SE APRECIA ESA SUJECIÓN EN LOS MONTOS PRETENDIDOS, que los costes deben ser equitativos y no individuales y su cálculo fue muy genérico.--- Criterio del Tribunal: A.- DE LAS COSTAS DE LA DEMANDA: En el presente caso, se ejecutada la sentencia Nº n.° 11-2019-IV de las 08:15 horas del 25 de febrero de 2019, dictada por la Sección IV del Tribunal Contencioso Administrativo, se dispuso: “POR TANTO (...) se declara CON LUGAR en todos sus extremos, la contrademanda interpuesta por la Contraloría General de la República contra Empresa Hotelera Dominical S.A., Punta Dominical S.A., Dieciocho Veintiuno S.A., Municipalidad de Osa, Instituto Costarricense de Turismo e Instituto Nacional de Vivienda y Urbanismo. Consecuentemente: [...] xv) Respecto de la demanda, se condena al pago de ambas costas a Empresa Hotelera Dominical S.A. y Punta Dominical S.A, a favor del Estado, la Contraloría General de la República y el Sistema Nacional de Áreas de Conservación, junto con los respectivos intereses legales, que se computarán a partir de la firmeza de la resolución mediante la cual se determine el quantum de las mismas y hasta su efectivo pago.
En lo atinente a la contrademanda, se condena a Empresa Hotelera Dominical S.A., Punta Dominical S.A, Dieciocho Veintiuno S.A., Municipalidad de Osa, INVU e ICT, al pago de ambas costas a favor de la Contraloría General de la República junto con sus respectivos intereses legales, que se computarán a partir de la firmeza de la resolución mediante la cual se determine el quantum de las mismas y hasta su efectivo pago.”, siendo que la misma se encuentra firme, se reconoce el derecho a costas de la parte ejecutante. En esta tesitura, tal y como lo peticiona la Contraloría, las costas personales deben ser fijadas en atención a las pretensiones pecuniarias (trascendencia económica), que resultan en las sumas que el actor peticionó en contra de las partes demandadas. Dicha trascendencia económica fue fijada en la audiencia preliminar y fue motivo de pronunciamiento por parte del Tribunal de Juicio, siendo sobre dicho rubro que deben ser aplicados los porcentajes dispuestos -para la cuantía- en el Decreto Ejecutivo vigente a la fecha de presentación de la demanda, que era el Arancel de Honorarios por Servicios Profesionales de Abogacía y Notariado Nº 32493.
Sin embargo, el ordinal 76.1 del Código Procesal Civil aplicable supletoriamente por disposición del numeral 220 del CPCA, sirve de parámetro al presente caso, así como la jurisprudencia de la Sala Primera, el Tribunal de Apelaciones de lo Contencioso Administrativo y de este Tribunal, que dispone -en lo medular- que "(…) Al respecto, la Sala ha establecido un cambio de paradigma en esta materia a partir de la entrada en vigencia del nuevo Código Procesal Civil (ver fallo 1236-2020). (…) La Ley 9142 (sic) trata que el pago al profesional sea lo más ajustado a la realidad, para lo cual impone tres variables: atención al trabajo (de carácter subjetivo y apreciación prudencial del juzgador), estado (fase procesal donde llegó la participación de la o el abogado) y trascendencia económica del proceso (de índole objetivo) (numeral 76.1), las cuales son constatables con la información del expediente; siempre bajo el parámetro del decreto -que será el monto máximo- y aplicando los principios de razonabilidad y proporcionalidad.
Lo anterior evita conceder emolumentos desproporcionados e implica que el juzgador deba justificar el monto que concede". (Sentencia 679-F-S1-2022 de las 8:30 horas del 22 de marzo de 2022, y 001674-F-S1-2024 de las 09:45 horas del 28 de noviembre de 2024 de la Sala Primera de la Corte Suprema de Justicia), que otorga a la persona juzgadora una cierta amplitud para la determinación y fijación de las costas, más allá de un simple ejercicio aritmético o cálculo matemático del Arancel, por lo que no es riguroso e inamovible en su orden de prelación, por lo que la persona Juzgadora puede realizar la fijación de las costas personales de un proceso una vez que ha recaído sentencia en contra de la parte vencida, utilizando los criterios convencionales, constitucionales y legales de proporcionalidad y razonabilidad. En este sentido, si bien la parte actora tiene una pretensión de reparación con una trascendencia económica, la valoración responde a las actuaciones de la parte ejecutante respecto a aspectos técnicos y/o científicos específicos, que revisten un especial abordaje, que conlleva una representación particularmente compleja necesitando apoyo técnico en la formulación de la demanda, atención de audiencias, ofrecimiento de prueba, audiencia preliminar y juicio, así como se estima la dificultad del asunto, lo extendido del tiempo de su tramitación, aspectos ampliamente justificados en el Considerando IV de la presente resolución, resultando razonable y proporcional a la labor empleada, por lo que se fija, en forma solidaria, por concepto de COSTAS DE LA DEMANDA en la suma de TRES MILLONES DE COLONES (₡3.000.000,00), a cargo de las dos co-actoras/vencidasEmpresa Hotelera Dominial S.A. y Punta Dominical--- En aplicación del principio de univocidad de las costas, la suma otorgada se divide entre El Estado, la Contraloría General de la República y el Sistema Nacional de Áreas de Conservación, en consecuencia le corresponde a la Contraloría y a El Estado, la suma de UN MILLÓN DE COLONES EXACTOS (₡1.000.000,00), y los montos restantes se reservan hasta que la otra parte realice su respectiva liquidación, conforme lo dispone el ordinal 156, 163, 165 del CPCA, puesto que no podrán beneficiarse -en su inacción- de lo otorgado a la parte ejecutante.-- En la misma tesitura, sobre la base de los argumentos legales, jurisprudenciales supra citados, estima este juzgador que se debe valorar, el tiempo investido, la complejidad del asunto, el abordaje de aspectos técnico/científicos, y los recursos invertidos para la contestación de la contra-demanda, la oposición de defensas, la atención de la audiencia preliminar, y juicio, aspectos ampliamente justificados en el Considerando IV de la presente resolución, resultando razonable y proporcional a la labor empleada, por lo que se fija, en forma solidaria, por concepto de COSTAS DE LA CONTRA-DEMANDA en la suma de CINCO MILLONES DE COLONES (₡5.000.000,00), a cargo de las reconvenidas/vencidas Empresa Hotelera Dominical S.A., Punta Dominical S.A. y Dieciocho Veintiuno S.A., y Municipalidad de Osa, INVU e ICT, a favor de la Contraloría General de la República.--- B.- DE LAS COSTAS DE CASACIÓN: Formula la representación de la Contraloría, reclamo por costas del recurso de Casación.
En este sentido debe tenerse que conforme al Arancel de Honorarios por Servicios Profesionales de Abogacía y Notariado Decreto Ejecutivo No. 32493 Arancel de Honorarios por Servicios Profesionales de Abogacía y Notariado que se encontraba vigente al momento de la demanda, se deben liquidar costas de casación según los parámetros establecidos en esa normativa.- En el presente asunto, se tiene que la parte actora, el ICT y la Municipalidad de Osa formularon recursos de casación en contra de la resolución de fondo, en relación con los cuales la Sala Primera de la Corte Suprema de Justicia, mediante resolución n.° 000861-F-S1-2023 de las 10:00 horas del 8 de junio de 2023, dispuso: “POR TANTO Se declara sin lugar los recursos formulados. Son las costas a cargo de los promoventes.”.-- Ahora bien con fundamento en la norma de rito, y la sentencia de marras -que condena a la parte actora/vencida al pago de las costas del recurso-, cuando se da la formalización del recurso de Casación como es el caso que nos ocupa, es procedente el reconocimiento de la suma mínima dispuesta por Ley y su base está dada por la norma 18 del citado arancel, que incrementa en un 25%, se le concede la suma de UN MILLÓN DE COLONES (₡1.000.000,00) a cargo, en forma solidaria, de la empresa Hotelera Dominical S.A, Punta Dominical S.A., ICT, y Municipalidad de Osa, y a favor únicamente de la Contraloría General de la República.--- C.- DE LOS INTERESES LEGALES: De las sumas otorgadas, se generan intereses legales de conformidad con los numerales 706 y 1163 del Código Civil, a partir de la firmeza de la presente resolución y hasta su efectivo pago.--- D.- DE LAS COSTAS DE EJECUCIÓN DE SENTENCIA: Peticiona la ejecutante el pago de costas de la fase de ejecución, la cual debe ser denegada por que la naturaleza dada por la Sala Primera a este tipo de resoluciones es de auto liquidatorio, al tenor de lo dispuesto por el numeral 193 del Código Procesal Contencioso Administrativo (contrario sensu), este tipo de procesos no contiene una condenatoria en costas personales por lo que se dispone sin especial condenatoria en costas de la ejecución de sentencia (entre otras ver sentencia Sala Primera de la Corte Suprema de Justicia N°000492-A-S1-2016 de las nueve horas veinticinco minutos del diecinueve de mayo del año dos mil dieciséis).---
Firme la presente resolución y conforme lo disponen los numerales 155 y siguientes del Código Procesal Contencioso Administrativo proceda el obligado depositar en la cuenta del despacho N° 09-001254-1027-CA - 3 la suma dispuesta en el término de UN MES.-
POR TANTO
De conformidad con las citas legales y jurisprudenciales citadas, se condena en forma solidaria, a las empresas PUNTA DOMINICAL S.A., EMPRESA HOTELERA DOMINICAL S.A, y EMPRESA DIECIOCHO VEINTIUNO S.A., por los daños y perjuicios ocasionados al ambiente y al Patrimonio Natural del Estado; y al INSTITUTO COSTARRICENSE DE VIVIENDA Y URBANISMO -INVU-, el INSTITUTO COSTARRICENSE DE TURISMO -ICT-, y la MUNICIPALIDAD DE OSA; por los daños y perjuicios generados a partir de las conductas administrativas activas u omisivas que han causado lesión al Patrimonio Natural del Estado y al ambiente, en la suma de TREINTA Y TRES MILLONES SETECIENTOS CINCUENTA Y CINCO MIL NOVECIENTOS SESENTA Y NUEVE COLONES EXACTOS (¢33.755.969,00).--- Se ordena como medida de aseguramiento la paralización, de forma inmediata, de cualquier obra actual o futura que se esté desarrollando en el sector del Restaurante “La Parcela” en Dominicalito de Osa, y se dispone que el SINAC y a la Municipalidad de Osa, colaborando con dicha institución, verifiquen el cumplimiento de lo dispuesto por este Tribunal, tomando las acciones de clausura y/o derivo, y se informe en el plazo de cinco días hábiles.--- Se ordena que la Municipalidad de Osa, al ICT y al INVU, informen sobre los ajustes necesarios realizados al Plan Regulador Costero de Punta Dominical, en el plazo de cinco días hábiles.--- Se ordena que en el plazo de quince días naturales, las empresas actoras/vencidas procedan con el desalojo voluntario del restaurante, el parqueo, las cabinas y demás construcciones que albergan el negocio, so pena, de que si no lo ejecuten en dicho plazo, se proceda con el desalojo definitivo y la demolición total de la totalidad de las infraestructuras, cabinas y edificaciones comerciales levantadas en el sector de "La Parcela", para lo que se comisiona a la Municipalidad de Osa para el desalojo y la demolición material, bajo la supervisión técnica del SINAC, en lo de su competencia, para proceder conforme se dispone en la sentencia y evitar nuevos daños ambientales.--- Se condena, en forma solidaria, por concepto de COSTAS DE LA DEMANDA en la suma de TRES MILLONES DE COLONES (₡3.000.000,00), a cargo de las dos co-actoras/vencidas Empresa Hotelera Dominical S.A. y Punta Dominical.
En aplicación del principio de univocidad de las costas, la suma otorgada se divide entre El Estado, la Contraloría General de la República y el Sistema Nacional de Áreas de Conservación, en consecuencia le corresponde a la Contraloría y a El Estado, la suma de UN MILLÓN DE COLONES EXACTOS (₡1.000.000,00), a cada una, y los montos restantes se reservan hasta que la otra parte realice su respectiva liquidación.- Se condena, en forma solidaria, por concepto de COSTAS DE LA CONTRA-DEMANDA en la suma de CINCO MILLONES DE COLONES (₡5.000.000,00), a cargo de las reconvenidas/vencidas Empresa Hotelera Dominical S.A., Punta Dominical S.A. y Dieciocho Veintiuno S.A., y Municipalidad de Osa, INVU e ICT, a favor de la Contraloría General de la República.-- Se condena por concepto de COSTAS DE CASACIÓN en la suma de UN MILLÓN DE COLONES (₡1.000.000,00) a cargo, en forma solidaria, de la empresa Hotelera Dominical S.A, Punta Dominical S.A., ICT, y Municipalidad de Osa, y a favor de la Contraloría General de la República.-- Las sumas otorgadas generan intereses de conformidad con el numeral 706 y 1163 del Código Civil desde la firmeza de la presente resolución y hasta su efectivo pago.-- Se resuelve sin especial condenatoria en costas de la fase de ejecución.-- Firme la presente resolución, deben los obligados depositar en la cuenta del despacho N° 09-001254-1027-CA - 3 en el término de UN MES la suma dispuesta, lo anterior de conformidad con el numeral 155 y las sanciones de los numerales 159 y 160 todos del Código Procesal Contencioso Administrativo.-- NOTIFÍQUESE.
