VOTO 326-2026 CRIMINAL SENTENCE APPEALS TRIBUNAL OF GUANACASTE, Santa Cruz, at sixteen hours fifteen minutes on the twenty-first of July, two thousand twenty-six.
Appeal filed in the present case 19-001157-0413-PE against [Name 001], [...], for the offense of TRANSPORT OF FOREST PRODUCTS MISAPPROPRIATED FROM PRIVATE PROPERTY, to the detriment of NATURAL RESOURCES. Participating in the decision on the appeal are Judge Brisa Campbell Argüello and Judges José Manuel Cisneros Mojica and Rodrigo Obando Santamaría. Licenciada Zaray Chavarría Prado appeared before this court on behalf of the Procuraduría General de la República.
BACKGROUND
I.By judgment number 292-2024, issued at 10:00 hours on September 26, 2024, the Trial Court of the Primer Circuito Judicial de Guanacaste, Cañas seat, ruled: "THEREFORE: In accordance with the provisions of articles 30(e), 31(a), 32(d), 311(d), 267, 270, 312, 313, and 340 of the Code of Criminal Procedure, and Art. 61 of the Ley Forestal #7575, having found that the criminal action was extinguished by the statute of limitations (prescripción), the definitive dismissal (sobreseimiento definitivo) of [Name 001] is hereby ordered for the offense of TRANSPORT OF FOREST PRODUCTS MISAPPROPRIATED FROM PRIVATE PROPERTY, to the detriment of NATURAL RESOURCES. The cessation of all precautionary measures against the defendant in the present case is hereby ordered. The civil damages action (acción civil resarcitoria) filed by the Procuraduría General de la República is hereby denied. No special costs order is imposed. The costs of the criminal proceedings shall be borne by the State. Once this ruling becomes final, the file shall be archived. NOTIFY. Alejandro Castro Salazar, Trial Judge, Criminal Court of the Primer Circuito Judicial de Guanacaste, Cañas seat" (SIC).
II.Against the foregoing ruling, Licenciada Zaray Chavarría Prado, on behalf of the Procuraduría General de la República, filed an appeal.
III.Upon completion of the corresponding deliberation in accordance with the provisions of the Code of Criminal Procedure, the Tribunal considered the issues raised in the appeal.
Opinion drafted by Judge Campbell Argüello; and,
WHEREAS
I.Admissibility. An appeal was filed against judgment number 292-2024, issued at 10:00 hours on September 26, 2024, which entered a definitive dismissal on grounds of extinction of the criminal action by the statute of limitations and denied the civil damages action. The appeal was filed by Licenciada Zaray Chavarría Prado, Procuradora Penal, in her capacity as private complainant (querellante) and civil plaintiff (actora civil). The challenge was submitted on October 16, 2024, and was received at the Tribunal del Primer Circuito Judicial de Guanacaste, Cañas seat, on October 17, 2024. The judgment was notified on September 27, 2024; accordingly, the 15-day period stipulated in Article 460 of the Code of Criminal Procedure elapsed on October 17, 2024. The appeal was therefore timely filed by a party with subjective standing (legitimación subjetiva) to do so, and it challenges a ruling that is subject to appeal pursuant to the doctrine of objective enumeration (taxatividad objetiva) under Articles 458 and 459 of the same code; accordingly, it is appropriate to decide the merits of both challenges.
II.First ground of appeal. The private complainant and civil plaintiff, in her capacity as Procuradora Penal, through a brief appearing at folios 155 to 163 of the file, presents two grounds of appeal. She sets out the factual background of the case that supported the complaint (querella) and the civil damages action. In her first claim, which she titles "Lack of reasoning in the judgment, in violation of Article 142 of the Code of Criminal Procedure," she argues that in this matter the lower court (a quo) found that the statute of limitations had run by determining that the hearing held on October 11, 2019, before the in-flagrante judge (juez de flagrancia) constituted an interrupting act for the statute of limitations—specifically, the preliminary statement (declaración indagatoria)—which she considers erroneous, because that hearing did not carry the implications attributed to it by the judge.
She contends that, pursuant to Article 426 of the Code of Criminal Procedure, the in-flagrante judge's only obligation at that hearing was to determine whether the court had jurisdiction over the matter, and that the Code of Criminal Procedure does not delegate the functions of the Ministerio Público to the in-flagrante judge. She relies on vote number 420-2018 of 09:45 hours of April 6, 2018, and vote number 2013-1897 of 14:53 hours of August 26, 2013, both from the Criminal Sentence Appeals Tribunal of the II Judicial Circuit of San José. She states that the judge declared lack of jurisdiction and referred the matter to ordinary proceedings on January 15, 2021, whereupon the prosecutor's office proceeded to take the preliminary statement on April 16, 2021, which, she maintains, is the act having the capacity to interrupt the statute of limitations, rather than the proceeding identified in the judgment.
Accordingly, when the preliminary hearing (audiencia preliminar) was scheduled for October 14, 2022, the statute of limitations was interrupted two days before the 18-month period elapsed. All of this establishes that the matter was not time-barred, as was erroneously stated in the judgment. She cites vote number 2019-1385 of August 9, 2019, from the Criminal Sentence Appeals Tribunal of the II Judicial Circuit of San José. She requests that the ground be upheld, the judgment annulled, and a remand (reenvío) for retrial ordered.
The ground is denied. The first point to be noted is that the Code of Criminal Procedure, specifically in Title Eight, which governs the expedited procedure for in-flagrante offenses (Articles 422 through 436), makes no express provision regarding limitation periods. However, Article 436 provides that, for matters not addressed in that title, the Code's rules shall apply supplementarily, insofar as they are compatible with the summary nature of the expedited procedure. The statute of limitations and its grounds for interruption evidently apply to in-flagrante proceedings; otherwise, a violation of the right to legality and equality before the law would result.
The Constitutional Chamber (Sala Constitucional) has indicated that, while the statute of limitations is not itself a right, there is a right to legal certainty (seguridad jurídica). In vote number 8391-1997 of 16:24 hours of December 29, 1997, it stated: "The statute of limitations on the criminal action—this Chamber has repeatedly held—is the cessation of the State's punitive power brought about by the passage of a legally prescribed period. In such cases, the State relinquishes the exercise of its punitive power and the right to apply a given penalty or to enforce a penalty already imposed in a specific case, which stems from the need to respect the principle of legal certainty for individuals. Against the State's power-duty to apply the law and prosecute crime, there also arises the right to resist that power, which is why the legislature establishes certain rules to limit it and protect citizens.
Thus, the right of defense and its derivatives—the right to know what to expect, which is the foundation of legal certainty—are but some of those rules that seek to balance the competing interests—those of the citizen and the State—all within the context of a system of law. It is, therefore, a procedural instrument that arises from the need to guarantee citizens that there will be no arbitrariness in the prosecution of crime, because against it the full force of objective parameters established by law operates, and no others. Other practical reasons also justify the existence of this institution, such as the fact that with the passage of time the punitive claim weakens and its exercise is ultimately deemed undesirable. Evidence is also destroyed or becomes difficult to obtain for a reasonable conduct of the proceedings. Added to this is the theory that the passage of time erases everything from human memory and, of course, the right not to be indefinitely threatened by the possibility of being tried for an offense that no longer holds procedural interest." Now, the statute of limitations is regulated beginning at Article 31 of the Code of Criminal Procedure, which establishes in subsection (a) that the criminal action shall lapse upon the expiration of a period equal to the maximum penalty for offenses punishable by imprisonment, provided it is not less than three years nor more than ten.
In this case, the defendant is charged with the transport of forest products misappropriated from private property, which, pursuant to Art. 61 of the Ley Forestal, carries a penalty of one month to three years of imprisonment. Accordingly, the limitation period is three years. Article 33, for its part, provides that once proceedings are initiated, the periods established in the preceding article shall be reduced by half, and in its subsection (a) it lists, as an interrupting act, the defendant's appearance to render a preliminary statement in cases involving public criminal actions. In the present case, the appellant does not challenge the lower court's calculation of the time elapsed between the defendant's preliminary statement and the next interrupting act—specifically, the scheduling of the preliminary hearing on October 14, 2022. Her disagreement lies in the assertion that the preliminary statement took place on April 16, 2021, before the prosecutor's office (cf. folio 65), after jurisdiction was declined and the matter was referred to the ordinary procedure; and therefore, the statement given by the defendant before the in-flagrante judge on October 11, 2019 (cf. folio 33) does not, in her view, constitute the interrupting event referred to in Article 33, subsection (a).
This Appellate Chamber agrees with the reasoning expressed by the trial court judge in finding that the statement given by the defendant before the in-flagrante judge does have the capacity to interrupt the statute of limitations. It must be noted that, even though Article 33(a) refers to a "preliminary statement" (declaración indagatoria), the Code of Criminal Procedure—in Chapter Two of Title Four (Articles 91 through 99)—regulates the statement of the defendant. This body of provisions expressly clarifies that the investigated person has the right to give a statement when deemed necessary; moreover, the defendant must be informed in detail of the attributed facts, the legal characterization, and a summary of the existing evidence. The defendant shall likewise be advised of the right to remain silent with respect to those facts and that such silence cannot be held against him or her. This body of provisions also establishes that, in order for the defendant to make a statement, the defendant must have the assistance of an attorney—either one of the defendant's own choosing or, failing that, a public defender.
It likewise establishes the duty to identify oneself (stating full name, civil status, and other data). Finally, if the investigated person wishes to make a statement, he or she shall be invited to express everything considered appropriate. This statement, as Article 95 clarifies, may only be received in the presence of defense counsel. In summary, the preliminary statement is composed of three elements: the duty to identify oneself, the right to be formally informed of the charges (intimación), and the opportunity to make a declaration in the presence of defense counsel. If we examine what took place at the initial hearing on October 10, 2019, all of these factual elements were met; therefore, regardless of the legal label one might wish to attach to it, the act materially constituted a preliminary statement.
This Chamber does not share the appellant's position that only a preliminary statement received by the Ministerio Público in the course of preparing an investigation in the ordinary procedure has the capacity to interrupt the limitation period. This is so because, upon a systematic interpretation of the Code of Criminal Procedure, the ordinary procedure is regulated in the second part of that code—pertaining to procedures—specifically in Book One beginning at Article 274. The defendant's statement thus falls outside the exclusive purview of the ordinary procedure, as it constitutes a fundamental right of every investigated person charged in criminal proceedings: to be informed of the attributed facts and to make a declaration thereon in the presence of defense counsel. This right is expressly regulated in Article 82 of the Code of Criminal Procedure—also situated outside the ordinary procedure—and provides that the Judicial Police, the Ministerio Público, and the judges, as applicable, shall immediately and comprehensibly inform the defendant of the following rights:
"a) To know the reason for deprivation of liberty and the official who ordered it, with the relevant order being exhibited as applicable.
In the present matter, on October 11, 2019, the defendant's statement was taken by the in-flagrante criminal judge, who first gave the floor to the prosecutor's representative to report the attributed facts, the legal characterization, and the evidence offered; the judge also identified and recorded all of the defendant's personal data, all in the presence of defense counsel. Thus, all of the requirements established by the aforementioned provisions governing the statement of an investigated person were fulfilled.
In addition to the foregoing, it must be noted that on January 11, 2021, once the defendant was apprehended and the fugitive status (rebeldía) ceased, the Tribunal de Flagrancia of Liberia scheduled a hearing for January 15, 2021. At that proceeding—which appears at folio 62 of the file and is titled "Minutes of the Oral and Public Trial (debate oral y público)"—the in-flagrante judge instructed the defendant to pay close attention to everything that would occur at trial, and also reminded the defendant that defense counsel was present to assist in the exercise of the right of defense. The judge then gave the floor to the Ministerio Público to formulate the charges, which it did; thereafter, the defense was given an opportunity to respond and raised no objection to the prosecutorial submission; following which, the tribunal declared itself without jurisdiction and ordered the matter referred to the ordinary procedure for a broader investigation.
That is to say, at the hearing held on January 15, 2021, the charges were set out before the defendant, who was informed of the attributed facts, the legal characterization, and the existing evidence against him. The defendant was also advised to pay close attention to the course of the proceedings and that defense counsel was present. Furthermore, the defendant's identification data had already been recorded as of the date of the initial hearing; it is therefore clear that a statement of the defendant was likewise received at that juncture. This is of particular relevance because, between that date (January 15, 2021) and the next interrupting act of the statute of limitations—constituted by the first scheduling of a preliminary hearing, set for October 14, 2022 (cf. folio 89 of the main file)—1 year, 8 months, and 29 days elapsed. This demonstrates that, between the second portion of the in-flagrante hearing (where the charges are formulated and the defendant is formally informed of them) and the said scheduling, a period in excess of one year and six months passed, which is the limitation period applicable to the charged offense.
Consequently, from any angle, the matter was time-barred by the time the second interrupting act occurred, just as the trial court declared. This Chamber finds that ruling to be in accordance with the law, and accordingly the ground of appeal raised by the Procuraduría General de la República is rejected.
III.Second ground of appeal. Titled "Lack of reasoning in the judgment, in violation of Article 142 of the Code of Criminal Procedure. Erroneous application of Article 40 of the Code of Criminal Procedure." The appellant challenges the inclusion in the operative section (parte dispositiva) of the judgment of the phrase: "the civil damages action filed by the Procuraduría General de la República is hereby denied." She reiterates her arguments as to why she considers the criminal action to not be time-barred, which has a direct bearing on the civil damages action, since, if the criminal action remains valid, so does the civil action. She argues that Article 40 of the Code of Criminal Procedure was erroneously applied, as it obligated the tribunal to rule on the civil damages action given that the case was at the trial stage. She further contends that Article 41 of the Constitución Política protects the right to prompt and complete justice, which is violated by the failure to resolve the civil claim.
She requests that the ground be upheld, the judgment annulled, and a remand for retrial ordered. The ground is partially upheld. As previously stated, the issue of the statute of limitations on the criminal proceedings was rejected; however, this same ground also alleges erroneous application of Article 40 of the Code of Criminal Procedure, as the appellant takes the view that the civil damages action should have been decided. On this point, under the legislation in force at the time the judgment was issued, it was expressly provided that the tribunal is only required to rule on the civil claim when it issues an acquittal; accordingly, such a ruling is not applicable in the case of a definitive dismissal entered prior to trial, as occurred in this matter. This Chamber reached an identical conclusion in vote number 174-2023 of 14:18 hours of April 17, 2023 (composed of Judges Dumani, Mendoza, and Cisneros).
For the foregoing reasons, the requested remand cannot be ordered. However, the lower court's error consisted in denying the civil damages action outright, when the appropriate course of action was to archive it and leave the ordinary civil forum open to the interested party, since, having not examined the merits of the claim, its outright dismissal was not warranted. Consequently, the challenged ruling is partially reversed insofar as it denied the civil damages action, and in its place, the archiving of said action is ordered, the right of the interested party to pursue its claims through the appropriate forum being preserved.
THEREFORE
The first ground of appeal filed by Licenciada Zaray Chavarría Prado, Procuradora Penal, is denied. The second ground is partially upheld and, accordingly, the challenged ruling is partially reversed solely insofar as it denied the civil damages action. In its place, the archiving of said action is ordered, the right of the interested party to pursue its claims through the appropriate forum being preserved. NOTIFY.

VOTO 326-2026 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. DE GUANACASTE , Santa Cruz, a las dieciséis horas quince minutos del veintiuno de julio de dos mil veintiséis.
Recurso de apelación interpuesto en la presente causa 19-001157-0413-PE seguida contra [Nombre 001], [...], por el delito de TRANSPORTE DE PRODUCTOS FORESTALES SUSTRAIDOS DE PROPIEDAD PRIVADA, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, la jueza Brisa Campbell Argüello y los jueces José Manuel Cisneros Mojica y Rodrigo Obando Santamaría. Se apersonó en esta sede la licenciada Zaray Chavarría Prado, en representación de la Procuraduría General de la República.
RESULTANDO
I.Mediante sentencia número 292-2024 de las 10:00 horas del 26 de setiembre del año 2024, el Tribunal de Juicio del Primer Circuito Judicial de Guanacaste, sede Cañas, resolvió: "POR TANTO: De conformidad con lo dispuesto en los artículos 30 inciso e) 31 inciso a, 32 nciso d, 311 inciso d), 267, 270, 312, 313 y 340 del Código Procesal Penal, 61 de la Ley Forestal #7575, por haberse operado la extinción de la acción penal por prescripción, se sobresee de forma definitiva al [Nombre 001] por el delito de TRANSPORTE DE PRODUCTOS FORESTALES SUSTRAÍDOS DE PROPIEDAD PRIVADA en perjuicio de LOS RECURSOS NATURALES. Se ordena el cese de cualquier medida cautelar que pese sobre el imputado dentro de la presente causa. Se declara sin lugar la acción civil resarcitoria planteada por la Procuraduría General de la Republica. Se resuelve sin especial condenatoria en costas. Los gastos del proceso por el ejercicio de la acción penal corren por cuenta del Estado. Firme esta resolución archívese el expediente. NOTIFÍQUESE. Alejandro Castro Salazar Juez de Juicio Tribunal Penal del primer Circuito Judicial de Guanacaste sede Cañas" (SIC).
II.Contra el anterior pronunciamiento la licenciada Zaray Chavarría Prado, en representación de la Procuraduría General de la República, interpuso recurso de apelación.
III.Verificada la deliberación respectiva de conformidad con lo dispuesto en el Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso.
Redacta la Jueza Campbell Argüello; y,
CONSIDERANDO
I.Admisibilidad. Contra la sentencia número 292-2024 de las 10:00 horas del 26 de setiembre de 2024, en el cual se dictó un sobreseimiento definitivo por extinción de la acción penal por prescripción y se declaró sin lugar la acción civil, formuló recurso de apelación la licenciada Zaray Chavarría Prado, Procuradora Penal en su condición de querellante y actora civil. La impugnación se presentó el 16 de octubre de 2024 y fue recibida en el Tribunal del Primer Circuito Judicial de Guanacaste, sede Cañas, el 17 de octubre de 2024. El fallo fue notificado el 27 de setiembre de 2024, con lo cual el plazo de 15 días estipulado en el numeral 460 del Código Procesal Penal, acaeció el 17 de octubre de 2024. Así las cosas, el recurso fue presentado en tiempo, por quien tiene legitimación subjetiva para ello y contra una resolución que es apelable (taxatividad objetiva) conforme a los artículos 458 y 459 del mismo cuerpo legal; por lo que corresponde resolver el fondo de ambas impugnaciones.
II.Primer motivo del recurso. La querellante y actora civil en su condición de procuradora penal, mediante escrito que consta a partir del folio 155 al 163 del expediente, presenta dos motivos de apelación. Expone como antecedentes del caso los hechos que sustentaron la querella y la acción civil. En su primer reclamo que denomina: “Falta de fundamentación de la sentencia, por violación del artículo 142 del Código Procesal Penal”. Alega que en este asunto el a quo consideró que había operado la prescripción al valorar que en la audiencia realizada el 11 de octubre de 2019 ante el juez de Flagrancia, constituye un acto interruptor de la prescripción, propiamente la declaración indagatoria, lo cual estima es erróneo, porque esa audiencia no tuvo las implicaciones que le atribuye el juez, pues de conformidad con el artículo 426 del Código Procesal Penal, en dicha audiencia el juez únicamente debe determinar si es competente o no para conocer el asunto, además de que en el Código Procesal Penal no se le delega al juez de flagrancia las funciones del Ministerio Público y se apoya en los votos número 420-2018 de las 09:45 horas del 6 de abril de 2018, y voto número 2013-1897 de las 14:53 del 26 de agosto de 2013, ambos del Tribunal de Apelación de Sentencia Penal del II Circuito Judicial de San José.
Refiere que el juez declaró la incompetencia y remitió el asunto al proceso ordinario en fecha 15 de enero de 2021, donde la fiscalía procedió a realizar la indagatoria en fecha 16 de abril de 2021, la cual, sostiene es la que tiene la capacidad de interrumpir la prescripción y no la que se señaló en el fallo. Debido a lo cual, cuando se señaló la audiencia preliminar el 14 de octubre de 2022, se interrumpió la prescripción, dos días antes de que acaeciera el plazo de los 18 meses. Todo lo cual permite acreditar que el asunto no prescribió como erróneamente se señaló en sentencia, cita el voto número 2019-1385 del 9 de agosto de 2019 del Tribunal de Apelación de Sentencia Penal del II Circuito Judicial de San José. Solicita se declare con lugar el motivo y se dicte la nulidad de la sentencia y se ordene juicio de reenvío.
Se declara sin lugar el motivo. Lo primero que debe indicarse es que, en el Código Procesal Penal, propiamente en el Título Octavo, en el cual se regula el procedimiento expedito para los delitos de flagrancia (a partir de los artículos 422 al 436), no se hace manifestación expresa sobre los plazos de prescripción. Sin embargo, en el artículo 436 se señala que, para lo que no fue previsto en este título, se aplicarán las regulaciones de este Código de manera supletoria, en tanto sean compatibles con la naturaleza célebre del procedimiento expedito. La figura de la prescripción y sus causales de interrupción evidentemente se aplican al procedimiento de flagrancia; de lo contrario, se constituiría una violación al derecho de legalidad e igualdad ante la ley.
La Sala Constitucional ha indicado que, si bien la prescripción no es un derecho, sí existe un derecho a la seguridad jurídica. En el voto número 8391-1997 de las 16:24 horas del 29 de diciembre de 1997 señaló: “La prescripción de la acción penal -ha dicho esta Sala reiteradamente- es la cesación de la potestad punitiva del Estado provocada por el transcurso de un determinado período fijado en la ley. El Estado, en estos casos, declina el ejercicio de su potestad punitiva y el derecho de aplicar una determinada pena, o hacer ejecutar la pena ya impuesta en un caso concreto, lo que tiene su origen en la necesidad de respetar el principio de seguridad jurídica de las personas. Ante el poder-deber del Estado de aplicar la ley y perseguir el delito, surge también el derecho a resistir ese poder y es por eso que el legislador establece ciertas reglas, para limitarlo y proteger al ciudadano. Así, el derecho de defensa y sus derivados, el de saber a qué atenerse -base de la seguridad jurídica-, son sólo algunas de esas reglas que buscan equilibrar los intereses en juego -los del ciudadano y el Estado-, todo dentro del contexto de un sistema de derecho.
Se trata, pues, de un instrumento procesal que surge ante la necesidad de garantizarle al ciudadano que no habrá arbitrariedad frente a la prosecución del delito, porque ante él opera la plena vigencia de los parámetros objetivos establecidos en la ley, y no otros. Otras razones de orden práctico también justifican la existencia de este instituto, como lo son el hecho de que con el transcurso del tiempo la pretensión punitiva se debilita y termina por considerarse inconveniente su ejercicio. También, se destruyen o se hace difícil la obtención de pruebas para una instrucción razonable del proceso. A ello se añade la teoría de que el paso del tiempo borra todo en la memoria de los hombres y, por supuesto, el derecho a no estar amenazado indefinidamente por la posibilidad de ser juzgado por un delito que ya no tiene interés procesal. “ Ahora bien, la figura de la prescripción se encuentra regulada a partir del artículo 31 del Código Procesal Penal, el cual establece en su inciso a) que la acción prescribirá transcurrido un plazo igual al máximo de la pena en los delitos sancionados con prisión, siempre que no sea inferior a tres años ni superior a diez.
En este caso, se le atribuye al imputado el delito de transporte de productos forestales sustraídos de propiedad privada, el cual, según el artículo 61 de la Ley Forestal, tiene una pena de un mes a tres años de prisión. De esta forma, el plazo de prescripción es de tres años. Por su parte, el artículo 33 señala que, una vez iniciado el procedimiento, los plazos establecidos en el numeral anterior se reducirán a la mitad, y en su inciso a) enumera como acto interruptor la comparecencia a rendir declaración indagatoria en los delitos de acción pública. En el presente caso, el apelante no reclama los cálculos realizados por el a quo respecto del tiempo transcurrido entre la declaración indagatoria del encausado y el siguiente acto interruptor —propiamente el señalamiento a audiencia preliminar de fecha 14 de octubre de 2022—. Su disconformidad radica en afirmar que la indagatoria ocurrió el 16 de abril de 2021 ante la Fiscalía (cfr. folio 65), luego de que se declarara la incompetencia y se remitiera el asunto a la vía ordinaria; por lo cual, la declaración del imputado realizada ante el juez de flagrancia el 11 de octubre de 2019 (cfr. folio 33) no constituye, a su parecer, la causal de interrupción del citado artículo 33, inciso a).
Esta Cámara de Apelación coincide con el criterio externado por el juez de instancia al estimar que la declaración que rindió el imputado ante el juez de flagrancia sí tiene la facultad de interrumpir la prescripción. Debe indicarse que, aun cuando el artículo 33 inciso a) habla de «declaración indagatoria», el Código Procesal Penal —en el Capítulo Segundo del Título Cuarto (a partir del artículo 91 al 99)— regula la declaración del imputado. En este articulado se aclara expresamente que la persona encargada tiene derecho a rendirla cuando lo estime indispensable; además, se le debe explicar detalladamente el hecho que se le atribuye, la calificación jurídica y un resumen del contenido de la prueba existente. Asimismo, se le indicará que tiene derecho a abstenerse de declarar sobre esos hechos y que su silencio no puede perjudicarle. Se indica también en este articulado que, para que el imputado declare, debe contar con la asistencia de un abogado —que puede ser de su confianza o, en su defecto, un defensor público—.
Asimismo, se establece la obligación de identificarse (indicando su nombre, apellidos, estado civil, entre otros datos). Finalmente, si la persona investigada desea declarar, se le invitará a expresar todo lo que considere conveniente manifestar. Esta declaración, aclara el artículo 95, solo podrá ser recibida en presencia de su defensor. En resumen, la declaración indagatoria se compone de tres elementos: el deber de identificación, el derecho a ser intimado y la oportunidad de rendir manifestación en presencia de su abogado defensor; si analizamos lo sucedido en la audiencia inicial del 10 de octubre de 2019 fueron cumplidos tales elementos fácticos, por lo que, independientemente de la etiqueta jurídica que quiera atribuírsele, el acto constituyó materialmente una declaración indagatoria.
No comparte esta Cámara el criterio del recurrente en cuanto a que únicamente la declaración indagatoria recibida ante el Ministerio Público posee la capacidad de interrumpir el plazo de prescripción. Esto es así porque, al realizar una interpretación sistemática del Código Procesal Penal, se observa que el procedimiento ordinario se encuentra regulado en la segunda parte del cuerpo normativo —relativa a los procedimientos—, propiamente en el Libro Primero y a partir del artículo 274. De este modo, la declaración del imputado se encuentra fuera de la regulación exclusiva del procedimiento ordinario, pues constituye un derecho fundamental de toda persona investigada a la que se le atribuye un proceso penal: ser informada respecto de los hechos que se le imputan y manifestarse sobre ellos en presencia de su defensor. Este derecho se regula expresamente en el artículo 82 del Código Procesal Penal —el cual también se ubica fuera del procedimiento ordinario— y señala que tanto la Policía Judicial, como el Ministerio Público y los jueces, según corresponda, le harán saber al imputado de manera inmediata y comprensible que le asisten los siguientes derechos:
“a) Conocer la causa o el motivo de su privación de libertad y el funcionario que la ordenó, exhibiéndole, según corresponda, la orden emitida en su contra.
En el presente asunto, el 11 de octubre de 2019, al imputado se le tomó su declaración por parte de la jueza penal de flagrancia quien, en un primer momento, le dio la palabra a la representación fiscal para que informara cuáles eran los hechos atribuidos, la calificación y la prueba ofrecida; además, identificó y tomó todos los datos personales del encausado, todo en presencia de su defensor. De esta forma, se cumplieron todos los requisitos que establecen las disposiciones normativas precitadas sobre la declaración de la persona investigada.
Aunado a lo anterior, debe indicarse que en fecha 11 de enero de 2021, una vez que el encartado fue detenido y cesó la rebeldía, el Tribunal de Flagrancia de Liberia señaló audiencia para el 15 de enero de 2021. En dicha diligencia —que consta a folio 62 del expediente y se titula «Acta de debate oral y público»—, la jueza de flagrancia le indicó al imputado que estuviera atento a todo lo que iba a ocurrir en el debate, además de recordarle que el defensor se encontraba presente para coadyuvarlo en el ejercicio de su derecho de defensa. Posteriormente, le otorgó la palabra al Ministerio Público para que formulara la acusación, como efectivamente lo hizo, de seguido le dio audiencia a la defensa, la cual no se opuso al requerimiento fiscal y a continuación, el tribunal se declaró incompetente y ordenó remitir el asunto al procedimiento ordinario para que se ampliara la investigación.
Es decir, en la audiencia celebrada el 15 de enero de 2021, se expuso la acusación al imputado, indicándosele los hechos atribuidos, la calificación jurídica y la prueba existente en su contra. Asimismo, se le advirtió que debía estar atento al desarrollo del debate y que se encontraba asistido por su abogado defensor. A lo anterior se aúna que, para la fecha de la audiencia inicial, ya se le habían tomado los datos de identificación, por lo que resulta claro que en ese momento también se recibió la declaración del imputado. Lo anterior cobra especial relevancia por cuanto, entre esa fecha (15 de enero de 2021) y el siguiente acto interruptor de la prescripción —constituido por el primer señalamiento para celebrar la audiencia preliminar, realizado el 14 de octubre de 2022 (cfr. folio 89 del legajo principal)—, transcurrió 1 año, 8 meses y 29 días. Esto demuestra que, entre la segunda parte de la audiencia de flagrancia (donde se formula la acusación y se intima al encausado) y el citado señalamiento, transcurrió un plazo superior al año y seis meses, el cual corresponde al plazo de prescripción por el delito atribuido.
En consecuencia, por donde se examine, el asunto se encontraba prescrito para el momento en que aconteció el segundo acto interruptor, tal como lo declaró el juez de instancia. Esta Cámara encuentra dicha resolución ajustada a derecho, razón por la cual se rechaza el motivo del recurso formulado por la Procuraduría.
III.Segundo motivo del recurso. Lo titula “Falta de fundamentación de la sentencia, por violación del artículo 142 del Código Procesal Penal. Errónea aplicación de lo dispuesto en el artículo 40 del Código Procesal Penal”. Impugna que en la parte dispositiva de la sentencia se consignó la frase:“ se declara sin lugar la acción civil resarcitoria planteada por la Procuraduría General de la República”. Reitera los argumentos del porqué estima que la acción penal no está prescrita, lo cual tiene impacto directo sobre la acción civil resarcitoria, toda vez que al permanecer vigente la acción penal también lo hace la acción civil. Sostiene que se interpretó erróneamente el artículo 40 del Código Procesal Penal que obligaba al tribunal a emitir criterio sobre la acción civil resarcitoria por encontrarse en fase de juicio. Señala que el artículo 41 de la Constitución Política, tutela el derecho a una justicia pronta y cumplida, la cual se ve vulnerado al no resolver la pretensión civil.
Solicita que se declare con lugar el motivo, se dicte la nulidad de la sentencia y se ordene juicio de reenvío. Parcialmente con lugar el motivo. Como se indicó previamente, el extremo referente a la prescripción del proceso penal fue rechazado; no obstante, en este mismo reproche se alega la errónea aplicación del artículo 40 del Código Procesal Penal, al estimar la recurrente que la acción civil debía ser resuelta. Sobre este punto, de frente a la legislación vigente al momento del dictado del fallo, se disponía expresamente que el tribunal únicamente debe pronunciarse sobre la pretensión resarcitoria cuando dicte una sentencia absolutoria; por ende, tal pronunciamiento no procede ante un sobreseimiento definitivo emitido antes del debate, como aconteció en la especie. En idéntico sentido se pronunció esta Cámara mediante el voto número 174-2023 de las 14:18 horas del 17 de abril de 2023 (integrada por las magistraturas Dumani, Mendoza y Cisneros).
Por lo anterior, no resulta factible ordenar el reenvío pretendido. Sin embargo, el yerro del a quo consistió en declarar sin lugar la acción civil, cuando lo adecuado era disponer el archivo y dejar expedita la vía ordinaria civil a la parte interesada, ya que, al no haberse examinado el fondo del reclamo, no resultaba procedente su desestimación. En consecuencia, se revoca parcialmente la resolución recurrida en cuanto declaró sin lugar la acción civil resarcitoria y, en su lugar, se dispone el archivo, pudiendo la parte acudir a la vía correspondiente a hacer valer sus derechos.
POR TANTO
Se declara sin lugar el primer motivo del recurso interpuesto por la licenciada Zaray Chavarría Prado, Procuradora Penal. Se declara parcialmente con lugar el segundo motivo y, en consecuencia, se revoca la resolución recurrida únicamente en cuanto declaró sin lugar la acción civil resarcitoria. En su lugar, se dispone el archivo de la referida acción, quedando a salvo el derecho de la parte interesada para acudir a la vía correspondiente a hacer valer sus pretensiones. Notifíquese.
