THE STATE No. 2026003869 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, at fifteen hours and eighteen minutes on the twelfth of June, two thousand and twenty-six.

Full merits administrative contentious proceeding (proceso de conocimiento contencioso administrativo) filed by Empresas Berthier EBI de Costa Rica S.A., corporate tax identification number (cédula jurídica) 3-101-215741, represented by Patricia Campos Villagra, of legal age, divorced, attorney and notary public, resident of San José, holder of national identity card number 1-880-762, in her capacity as General Manager with the powers of unlimited general attorney-in-fact (Apoderada Generalísima sin límite de suma); against The State, which has acted under the direction of Attorney Georgina Inés Chaves Olarte, bar registration number 4800. Attorney Luis Lechtman Meltzer, professional registration number 10808, has acted as lead counsel for the plaintiff.

WHEREAS:

FIRST. PROCEDURAL BACKGROUND:

  1. 1By means of a petition brief (libelo) filed on April 30, 2020, Empresas Berthier EBI de Costa Rica S.A. commenced a full merits administrative contentious proceeding, in which it made the following claims: "In accordance with the facts, legal grounds, and evidence submitted to the record, I respectfully request that in the judgment: 1) A finding of substantial non-conformity with the legal order be decreed, and consequently, that the absolute nullity of Resolution No. 0320-2020-SETENA, issued at 10:00 hours on February 21 (sic) of 2020, adopted by the SETENA Plenary Commission (Comisión Plenaria) by means of Article No. 2 of Ordinary Session No. 017-2020 of February 25 (sic) of 2020, be declared. 2) The absolute nullity of all acts connected with the formal conduct challenged herein also be declared. 3) In the event of opposition to the present complaint, the State be ordered to pay both court costs (costas) of this proceeding, together with the corresponding statutory interest, to be computed from the date on which such costs are definitively determined, until their effective payment." (Images 2 through 39 of the judicial case file).
  2. 2On July 2, 2020, The State filed a negative answer to the complaint and raised the defenses of lack of right, lack of active and passive standing (legitimación activa y pasiva), and lack of current interest. Subsequently, at the closing-arguments stage, it alleged inadmissibility on the grounds that the act is not subject to challenge. It requested that the judgment declare the complaint without merit in all its aspects, and order the plaintiff to pay both court costs, as well as interest on those costs.   3. 3On December 15, 2020, a preliminary hearing (audiencia preliminar) was held, attended by all parties. No defective procedural activity was raised. The claims were ratified in the same terms as expressed in the petition brief. Facts 5, 7, 9, 10, 11, 12, 13, 14, 15, 19, 20, and 21 of the complaint were designated as disputed. The documentary evidence offered was admitted, the matter was declared to be purely a question of law (de puro derecho), and a period was granted for the parties to submit written closing arguments (conclusiones). (Images 318 through 321 of the judicial case file, as well as the recording of the hearing included in the electronic file).
  4. 4Both parties submitted their closing arguments within the period granted for that purpose. (Images 324 through 366 of the judicial case file).
  5. 5That, by means of an agreement adopted by the Consejo Superior del Poder Judicial in session No. 26-2025, held on March 27, 2025, ARTICLE XXXII, a judicial caseload-reduction plan (plan de descongestionamiento) was approved to reduce judicial backlog (rezago judicial) in purely legal matters before the TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, designed by the Dirección de Planificación and set forth in report No. 310-PLA-MNP-2025, dated March 14, 2025. Given that the present case file meets the established criteria, it was included in the aforementioned caseload-reduction plan and assigned to this Section for decision on May 30, 2024.   6. 6The present judgment is rendered following deliberation and by unanimous vote of the members of the Tribunal, with no procedural defects or omissions observed that could give rise to nullity or denial of due process to the parties. Drafted by Judge Irías Obando with the affirmative vote of Judge Madriz Martínez and Judge Herrera Valverde.

SECOND. PROVEN FACTS. In what is relevant given the manner in which this matter is resolved, the review of the arguments and documents submitted by the parties allows the following facts to be established as proven:

  1. 1That Empresas Berthier EBI de Costa Rica S.A., corporate tax identification number 3-101-215741, operates the sanitary landfill (relleno sanitario) known as "Parque de Tecnología Ambiental Uruka" (hereinafter PTA Uruka), located in La Carpio, Uruca, San José, under the Environmental Viability (Viabilidad Ambiental) granted by SETENA through Resolution No. 652-2000-SETENA, issued at 12:00 hours on July 18, 2000. The project is processed under administrative case file (expediente administrativo) No. FEAP-718-1998-SETENA. By means of Resolution No. 2628-2012-SETENA dated October 10, 2012, SETENA approved the update of the Environmental Management Plan (Plan de Gestión Ambiental) for the project, which included the technical closure (cierre técnico) and post-technical closure of the sanitary landfill. (Administrative case file FEAP-718-1998-SETENA, Volumes I and following; folios 4717 through 4831 of Volume 24 and folio 7296 of Volume 35 of the administrative case file. Documents visible in images 42 through 151 of the electronic case file.)
  2. 2That the company Berthier EBI de Costa Rica S.A. was the subject of a complaint before the Tribunal Ambiental Administrativo in file No. 215-07-02-TAA. That proceeding concluded with Resolution No. 1364-18-TAA, issued at eleven hours and fifteen minutes on December 13, 2018, which in its operative part (parte dispositiva) ordered, among other things: "...XI. ORDERS Dr. Daniel Salas Peraza in his capacity as Minister of the Ministerio de Salud, or whoever holds that office, IN COORDINATION WITH SETENA, in the person of Mr. Sergio Bermúdez Muñoz or whoever holds that office, to proceed to maintain strict oversight over the topographic measurement, so that once the elevation of 985 meters above sea level (msnm) is reached, the technical instructions be issued to commence the technical closure process, as required by law." Upon the request for addition and clarification filed by the company, the Tribunal issued Resolution No. 461-19-TAA, whereby it rejected that request and affirmed what had been resolved in Resolution No. 1364-18-TAA, clarifying in its recital clauses (parte considerativa) that the useful life (vida útil) of a sanitary landfill may vary over time according to multiple factors, and specifying in its operative part that the elevation of 985 msnm was the limit for initiating the technical closure, provided that no modifications had been approved through the legally established procedures and by the competent authorities.(Resolutions No. 1364-18-TAA and No. 461-19-TAA of the Tribunal Ambiental Administrativo, referenced in the Resultandos and Considerandos of Resolution No. 0320-2020-SETENA, visible at folios 7589 through 7611 of Volume 37 of the administrative case file.)
  3. 3That on February 23, 2019, the company Empresas Berthier EBI de Costa Rica S.A. complied with the order contained in Resolution No. 1364-18-TAA by submitting to the Tribunal Ambiental Administrativo the three mitigation plans required by that resolution: a) Plan for the mitigation of noise, especially during nighttime hours; b) Plan for the control of dust and gases; and c) Plan for contamination caused by odors from work fronts. This compliance was expressly acknowledged in Considerando Fifth of Resolution No. 2064-2019-SETENA, which stated: "...it is confirmed that the company Empresas Berthier EBI de Costa Rica S.A. has complied with what was determined by the Tribunal Ambiental Administrativo with respect to Resolution 1364-18-TAA of December 13, 2018... Said Plans were submitted before that Tribunal on February 23, 2019." (See Considerando Fifth of Resolution No. 2064-2019-SETENA, folios 7432 through 7474 of Volume 37 of the administrative case file).
  4. 4That on January 31, 2019, the company Empresas Berthier EBI de Costa Rica S.A. submitted to SETENA the Operational Technical Closure Proposal entitled "Plan de Acciones para el Cierre Operativo del PTA URUKA," supplemented by a Geotechnical Technical Study prepared by the company INSUMA S.A. (Stability Analysis for the proposed Technical Closure at elevation 995 msnm) and a set of conceptual plans. That geotechnical study concluded that under current conditions and future conditions upon reaching elevation 995 msnm, the sanitary landfill is stable. (See folios 7268 through 7301, images 175 through 208 of Volume 35 of the administrative case file.)
  5. 5That on November 1, 2019, the Ministerio de Salud issued the compliance report through the APC Platform of the Colegio Federado de Ingenieros y Arquitectos for project CFIA-884423 "Cierre Técnico Operativo PTA Uruca," approving the Plan de Acciones para el Cierre Operativo submitted by the company. The compliance report took into account, among other considerations, that the INSUMA S.A. geotechnical study concluded that the landfill is stable under current and future conditions at elevation 995 msnm, and that it respected the content of Resolution No. 2064-2019-SETENA. (See Resolution No. 0872-2020-SETENA, folio 7764 of Volume 38; office memorandum MS-DPRSA-360-2020, folios 7672 through 7680 of Volume 38 of the administrative case file.)
  6. 6That by means of Resolution No. 2064-2019-SETENA, issued at fourteen hours on June 28, 2019, the SETENA Plenary Commission in Ordinary Session No. 063-2019, Article No. 02, ordered: "FIRST: To approve the 'Plan de Acciones para el Cierre Operativo del PTA URUKA,' which is a complement to the environmental management process of the project. SECOND: Based on the projections of the developing company, available development areas (terraces), and the proposed elevation levels of 995 msnm and 969.6 msnm, a remaining useful life of four years is established within which to effect the operational closure of the project and commence post-closure activities (monitoring and control). At least one year before this period ends, the developer shall update the corresponding technical studies regarding topographic levels, stability, and remaining volumetric capacity. THIRD: To notify this resolution to the Dirección de Protección al Ambiente Humano of the Ministerio de Salud so that, within the scope of its jurisdiction, it may consider the proposed works during the technical operational closure process and post-closure activities, and report any corresponding observations to this Secretariat.FOURTH: The developer has a duty to continue complying with environmental regulations. FIFTH: Against this resolution, the ordinary remedies of revocation (revocatoria) before SETENA and appeal (apelación) before the Minister of Ambiente, Energía y Telecomunicaciones may be filed within three business days, counted from the business day following notification, in accordance with Articles 342 and following of the Ley General de Administración Pública N° 6227 and Article 87 of the Ley Orgánica del Ambiente N° 7554." (See folios 7432 through 7474 of Volume 37 of the administrative case file, images 107 through 121).
  7. 7That on July 4, 2019, Ms. Melissa Flores Núñez, representative of the Asociación de Desarrollo de Residencial Ciudad Cariari (ASOCARIARI), filed a partial petition for revocation (Recurso de Revocatoria parcial) with a subsidiary appeal (Apelación en Subsidio) against Resolution No. 2064-2019-SETENA (consecutive 5450 AJ). On July 23, 2019, Empresas Berthier EBI de Costa Rica S.A. filed a written opposition to that remedy. On February 19, 2020, the company filed a second written opposition. (See folios 7475 through 7478 and 7480 through 7490 of Volume 37 of the administrative case file.)
  8. 8That by means of office memorandum SETENA-AJ-0712-2019 dated December 2, 2019, the SETENA Legal Department requested a technical opinion from the Departamento de Auditoría y Seguimiento Ambiental to resolve the petition for revocation filed by Ms. Melissa Flores Núñez. In response, that Department issued report SETENA-DT-ASA-1690-2019 dated December 13, 2019, signed by Eng. Alejandro González Barquero (Acting Coordinator) and M.Sc. Eng. Oscar Umaña Fernández (Environmental Specialist), in which the following was established: "FIRST: It must be taken into account that the resolution of the Tribunal Ambiental that established a landfill elevation of 985 was based on an elevation self-imposed by the Developer, based on the technical-scientific information available at the time regarding the conditions of the landfill. That is, this value was not issued by any other governmental body as the result of a bearing-capacity study.SECOND: The elevation increase approved by this Secretariat to a new value of 995 arises as the result of technical studies conducted by the company INSUMA, which, using simulation and/or modeling programs, determined that the height of the landfill can be modified up to elevation 995 with an adequate safety factor and without jeopardizing the stability of the landfill. The increase in height, and hence in capacity, is therefore the result of a scientific analysis conducted in situ and in accordance with the Ministerio de Salud Decree on Sanitary Landfills. THIRD: As the Ministerio de Salud has stated, the receiving capacity of a sanitary landfill is variable and depends on many factors, and only through ongoing studies over time can the volumetric variation of waste be determined, allowing the receiving capacity of the landfill to be calculated under appropriate safety conditions. FOURTH: Therefore, the elevation value of 985 indicated in the resolution of the Tribunal Ambiental was mentioned by the project developer at that time as an internal planning measure, for which viable information was available at that moment, and not because a value representing a risk or danger to the project and its surroundings had been reached." (See report SETENA-DT-ASA-1690-2019, images 200 through 213 of the electronic case file; folio 7492 of Volume 37 of the administrative case file.)
  9. 9That by means of Resolution No. 0320-2020-SETENA, issued at 10:00 hours on February 21, 2020, adopted by the SETENA Plenary Commission by means of Article No. 2 of Ordinary Session No. 017-2020 of February 25, 2020, the partial petition for revocation with subsidiary appeal filed by Melissa Flores Núñez against Resolution No. 2064-2019-SETENA was resolved. In its Por Tanto, the following was ordered: "FIRST: THE PETITION IS GRANTED and Resolution No. 2064-2019-SETENA is revoked in compliance with the resolutions of the Tribunal Ambiental Administrativo. With regard to the request for the 'Plan de Acciones para el Cierre Operativo del PTA URUKA,' supplemented by the Geotechnical Technical Study and set of conceptual plans of the proposal, this matter is reserved for consideration once the technical information required in the Second Operative Clause is available. The foregoing is due to the fact that the resolution of the Tribunal Ambiental Administrativo establishing an elevation of 985 msnm and ordering coordination with the Ministerio de Salud was not taken into account in the study.Accordingly, pursuant to Considerando Second of this resolution and based on the Tribunal's resolution, actions are set out for the analysis of the Technical Closure. SECOND: The Ministerio de Salud is requested to: 1. Establish, in accordance with the order of the Tribunal Ambiental Administrativo, the parameters under which the technical closure of PTA URUKA is to be carried out with respect to elevation 985 msnm. 2. Indicate the new parameters so that the developer may submit the 'Plan de Acciones para el Cierre Operativo del PTA URUKA.' 3. Conduct the topographic survey of the elevation measurement, establish the updated volumetric capacity and remaining useful life. All of the foregoing within a period of 10 business days. Given that the technical closure actions fall within the jurisdiction of the Ministerio de Salud, this Secretariat requests to be kept informed of all corresponding actions.THIRD: To notify the developer that, once the information requested from the Ministerio de Salud in the Second Operative Clause is available, it will be informed of the guidelines under which the technical closure must be carried out. FIFTH: Against this resolution, the ordinary remedies of revocation before SETENA and appeal before the Minister of Ambiente, Energía y Telecomunicaciones may be filed within three business days, counted from the business day following notification, in accordance with Articles 342 and following of the Ley General de Administración Pública N° 6227 and Article 87 of the Ley Orgánica del Ambiente N° 7554." (See folios 7589 through 7611, images 276 through 298, of Volume 37; also visible at folio 7705 of Volume 38 of the administrative case file.)
  10. 10That by means of office memorandum No. MS-DPRSA-255-2020 dated February 27, 2020, issued by the Dirección de Protección Radiológica y Salud Ambiental of the Ministerio de Salud in response to office memorandum SETENA-SG-0328-2020, the Ministerio de Salud informed SETENA that: i) according to the operational report for the fourth quarter of 2019, an intake of 700 tons per day was estimated with a projected useful life of approximately four to five years; and ii) the maximum approved elevation for the sanitary landfill cells is 995 msnm, that elevation being part of the operational technical closure works pursuant to Resolution No. 2064-2019-SETENA. (See folios 7618 through 7630, images 306 through 316, of Volume 37 of the administrative case file; submitted as Evidence 6 of the electronic case file, images 200 through 213.)
  11. 11That on March 9, 2020, Empresas Berthier EBI de Costa Rica S.A. filed a petition for revocation with a subsidiary appeal against Resolution No. 0320-2020-SETENA. That remedy was resolved by means of Resolution No. 0794-2020-SETENA, issued at 09 hours 45 minutes on April 29, 2020, adopted by the SETENA Plenary Commission in Ordinary Session No. 034-2020, Article No. 17, which ordered: "FIRST: In accordance with the factual and legal grounds set forth in Considerando Second of this resolution, the petition for revocation against Resolution No. 320-2020-SETENA is rejected as inadmissible, on the grounds that the act being challenged is not subject to review pursuant to Article 345 of the LGAP, the remedy stage was procedurally barred (precluyó) upon issuance of Resolution No. 0320-2020, and the administrative avenue has been exhausted. SECOND: Given that the subsidiary appeal was also filed, and the petition for revocation having been declared inadmissible, the subsidiary appeal is elevated for consideration by the Minister of Ambiente y Energía." (See Resolution No. 0794-2020-SETENA, folio 7731 of Volume 38 of the administrative case file.)
  12. 12That by means of office memorandum No. MS-DPRSA-360-2020 dated March 31, 2020, issued by the Dirección de Protección Radiológica y Salud Ambiental of the Ministerio de Salud in response to the request made by Resolution No. 0320-2020-SETENA, the Ministerio de Salud indicated that it is the body responsible for approving sanitary landfill closure projects through the APC Platform of the Colegio Federado de Ingenieros y Arquitectos, that it had already approved the Plan de Acciones para el Cierre Operativo del PTA Uruka on November 1, 2019, including the transitional elevation of 995 msnm, and that: "(…) The matter of final waste disposal cannot be disregarded, as final disposal at unauthorized sites becomes a public health problem. For that reason, the Ministerio de Salud, as the governing authority in this matter, approves — as previously indicated — how the technical closure will be carried out. Until the technical closure takes place, the Ministerio de Salud, applying technical criteria in a reasonable and proportionate manner, approves projects that may temporarily increase the elevation to facilitate the operation of sanitary landfills, so as to subsequently proceed to the technical closure." (See folios 7672 through 7680, images 11 through 29, of Volume 38 of the administrative case file.)
  13. 13That by means of Resolution No. 0872-2020-SETENA, issued at 13:00 hours on May 11, 2020, the SETENA Plenary Commission in Extraordinary Session No. 001-2020, Article No. 02, ordered in its Por Tanto: "FIRST: The Ministerio de Salud report referred to in office memorandum MS-DPRSA-360-2020 dated March 31, 2020 is noted. SECOND: In the technical closure procedure of the PTA LA URUKA sanitary landfill, SETENA defers to and subjects itself to the powers and competencies invoked by the Ministerio de Salud in the aforementioned report, without prejudice to the oversight powers that are inherent to this Secretariat. THIRD: In light of the foregoing, the Departamento de Auditoría y Seguimiento Ambiental is instructed to continue monitoring compliance with the Environmental Commitments (Compromisos Ambientales) of the referenced project." (See folio 7764 of Volume 38 of the administrative case file.)

THIRD. UNPROVEN FACTS. Sufficient evidence was not submitted to establish the following facts constitutive of the right invoked by the parties.

1. That Resolution No. 0320-2020-SETENA was expressly or tacitly revoked, annulled, set aside, or replaced by any subsequent administrative act, including Resolution No. 0872-2020-SETENA.

FOURTH. THEORY OF THE CASE. SUMMARY OF THE CLAIM. The following is a summary of the contents of the statement of claim (libelo de demanda) and of the written closing arguments submitted, it being noted that the Tribunal has considered all arguments of the parties in detail and will address them in the corresponding sections where appropriate. Regarding the factual background, the plaintiff's representative states that on December 11, 1998, the Preliminary Environmental Assessment Form (Formulario de Evaluación Ambiental Preliminar) for the project known as Parque de Tecnología Ambiental was filed before SETENA, processed under administrative file No. 718-1998-SETENA in the name of the represented party. On November 17, 1999, the Comprehensive Environmental Impact Study (Estudio de Impacto Ambiental Exhaustivo) for the project was submitted for evaluation. On February 3, 2000, through Resolution No. 093-2000-SETENA, that study was approved, with the Declaration of Environmental Viability (Declaratoria de Viabilidad Ambiental) being conditioned on compliance with a series of requirements specified in the decision, including the posting of an environmental bond (garantía ambiental), the appointment of an environmental manager (responsable ambiental), the formation of a Monitoring Commission (Comisión de Monitoreo), and the submission of periodic oversight reports.

Through Resolution No. 652-2000-SETENA of July 18, 2000, Environmental Viability (Viabilidad Ambiental) was formally granted to the project. It is likewise noted that on July 30, 2012, an update to the Environmental Management Plan (Plan de Gestión Ambiental) for the project was submitted to SETENA, which was endorsed by Resolution No. 2628-2012-SETENA at 13:45 on October 10, 2012. That update contemplated the technical closure (cierre técnico) and the technical post-closure (post-cierre técnico) of the project. Under that approved proposal, the process required operational closure activities that would be carried out in parallel with the ordinary operating activities of the landfill (relleno sanitario), with the purpose of achieving an orderly closure as normal operations progressed.

The representative states that the company was reported to the Tribunal Ambiental Administrativo under file No. 215-07-02-TAA for alleged environmental violations, a proceeding that concluded with Resolution No. 1364-18-TAA of December 13, 2018. In that decision, the Tribunal Ambiental Administrativo ordered, insofar as relevant, that strict monitoring be maintained over the topographic survey, so that once elevation level (cota) 985 msnm was reached, technical instructions would be issued to proceed with the technical closure process as required by law. In response to a motion for clarification and addition filed by EBI, the Tribunal Ambiental Administrativo issued Voto 461-19-TAA of March 25, 2019, in which it analyzed the variable nature of the useful life (vida útil) of a landfill based on multiple technical factors and reiterated its ruling regarding elevation 985 msnm as the threshold for initiating the technical closure process.

On January 31, 2019, through communication No. 0825-ASA, the Operational Technical Closure Proposal was submitted to SETENA. On April 9, 2019, an inspection visit to the project was carried out by an environmental specialist from the Department of Environmental Audit and Monitoring (Departamento de Auditoría y Seguimiento Ambiental) of SETENA, who confirmed that the project was in normal operation, that no vectors (vectores) such as birds or rats were observed mixing with the waste, that the treatment plant was functioning correctly without emitting unpleasant odors, that the slopes (taludes) appeared stable, and that the truck disinfection and washing system was operating adequately. In that same context, it was identified that wastewater (aguas residuales) from neighboring houses was being discharged into the landfill without treatment.

The plaintiff's representative states that through Resolution No. 2064-2019-SETENA of fourteen hundred hours on June 28, 2019, issued at Ordinary Session No. 063-2019, the Full Commission (Comisión Plenaria) resolved to approve the Operational Closure Action Plan (Plan de Acciones para el Cierre Operativo) for the PTA Uruka project as a complement to the project's environmental management process. That resolution established, based on the company's projections and the technical studies submitted, that the estimated remaining useful life was four years for completing the operational closure, projecting elevation levels of up to 995 msnm and 969.6 msnm. It was also indicated that at least one year before the end of that period the developer would need to update the corresponding technical studies. On July 4, 2019, Ms. Melissa Flores Núñez, of the Asociación de Desarrollo de Residencial Ciudad Cariari (ASOCARIARI), filed a partial motion for reconsideration with appeal in the alternative (recurso de revocatoria parcial con apelación en subsidio) against that resolution. The company filed a written opposition to the motion on July 23, 2019, and again on February 19, 2020.

The plaintiff states that through Resolution No. 0320-2020-SETENA, the subject of this proceeding, the Full Commission resolved to revoke Resolution No. 2064-2019-SETENA, purportedly in compliance with the decisions of the Tribunal Ambiental Administrativo. The plaintiff alleges that said resolution completely disregarded Report SETENA-DT-ASA-1618-2019, issued by SETENA's own Department of Environmental Audit and Monitoring, which had been requested in order to resolve the motion for reconsideration and which concluded, in summary, that elevation 985 msnm had not been established by any governmental authority as the result of a load-bearing capacity study (estudio de capacidad soportante) but had instead been an internal planning measure adopted by the developing company; that the elevation increase endorsed to 995 msnm arose from scientific technical studies that determined its viability with an adequate safety factor (factor de seguridad); and that the receiving capacity of a landfill is variable and depends on multiple factors that can only be determined through ongoing studies.

Likewise, the challenged resolution disregarded official letter MS-DPRSA-255-202027 of February 27, 2020, issued by the Dirección de Protección al Ambiente Humano of the Ministerio de Salud, which stated that the maximum approved elevation for the landfill cells (celdas) was 995 msnm as part of the operational technical closure works pursuant to Resolution No. 2064-2019-SETENA, and that the useful life must be periodically updated by the landfill administrator in accordance with the Reglamento sobre Rellenos Sanitarios.

In the legal grounds, the plaintiff's representative develops a series of defects (vicios) that, in its view, render the challenged resolution absolutely null. First, it alleges a defect in the grounds (motivo) and content (contenido) of the administrative act (acto administrativo), arguing that the resolutions of the Tribunal Ambiental Administrativo were fully complied with by its principal. Relying on the definition of the grounds of an administrative act as enshrined in Article 133 of the Ley General de la Administración Pública and in the doctrine of scholar Ernesto Jinesta Lobo, it maintains that the grounds must be legitimate and must exist as they were taken into account when the act was issued. In the specific case, it argues that the grounds are non-existent because at no point was there any failure to comply with the orders of the Tribunal Ambiental: EBI timely submitted the three plans required by that Tribunal, namely, the nighttime noise mitigation plan, the dust and gas control plan, and the plan for contamination caused by odors at the working faces.

This was acknowledged in Resolution No. 2064-2019-SETENA itself. The plaintiff clarifies that the company did not seek to extend the project's useful life in an unlawful manner, but rather submitted to the environmental and public health authorities an orderly technical closure plan, which entails the project continuing to operate during the closure phase in order to generate the financial resources necessary to cover the high costs of closure. Since the grounds are non-existent, the absolute nullity (nulidad absoluta) extends inescapably to the content of the act, pursuant to Article 132 of the Ley General de la Administración Pública.

As a second ground of challenge, the plaintiff's representative addresses the issue of technical closure and compliance with the orders of the Tribunal Ambiental Administrativo. It states that elevation 985 msnm was never imposed as a height requirement by SETENA or by the Ministerio de Salud, but was instead established by the company itself as an internal planning reference indicating when the operational closure stage should begin. It clarifies that that elevation was taken into account in the Tribunal Ambiental Administrativo's resolution based on the technical information available at the time, without that implying that reaching that elevation represented a risk to the project or its surroundings. The determination of the project's useful life, the plaintiff maintains, is the responsibility of the developer through technical studies estimating the availability of usable space, as recognized by official letter DRS-UN-0624-2012 of the Ministerio de Salud and ratified by official letter MS-DPRSA-255-2020 of February 27, 2020.

The third ground of challenge concerns the lack of jurisdiction of the Tribunal Ambiental Administrativo to deny, restrict, or reject new projects, addenda (adendas), or expansions of existing projects. Relying on Article 111 of the Ley Orgánica del Ambiente, the plaintiff argues that the powers of that Tribunal are limited to receiving complaints and ascertaining whether environmental violations exist, with no authority over new projects or expansions of existing ones. It interprets the challenged resolution as having confused the legality review (contralor de legalidad) function of the Tribunal Ambiental Administrativo with a co-administration (coadministración) function, which is legally impermissible, since that Tribunal has no authority to evaluate new projects or to interpret its own resolutions beyond its competence — a task that falls exclusively to the technical bodies of the Ministerio de Salud and SETENA.

In this regard, the plaintiff invokes Resolution No. 2010-5219 of the Sala Constitucional, which recognized that the technical closure of a landfill is an administrative act of the health authorities who evaluate the technical conditions that motivated it, and that it is not for any other body to substitute for the health authorities in ordering such closure if it has not been technically demonstrated that such a measure is the most advisable. Since ASOCARIARI never submitted any technical evidence to rebut the studies underpinning Resolution No. 2064-2019-SETENA, and since the motion for reconsideration was upheld without that technical support, the defect in the challenge was transferred to the challenged act, rendering it null for defect in the grounds and content.

The fourth ground of challenge concerns Report SETENA-DT-ASA-1618-2019 of the Department of Environmental Audit and Monitoring, the existence of which was entirely disregarded by the challenged resolution. The plaintiff alleges that that report, prepared by SETENA's own technical staff at the request of the Legal Department to resolve the motion for reconsideration, reached conclusions decisively favorable to maintaining the effects of Resolution No. 2064-2019-SETENA. Nevertheless, the Full Commission neither evaluated it nor acknowledged its existence in any of its considerandos. The plaintiff notes that this intentional omission of an essential evidentiary element demonstrates the arbitrariness of the act and establishes that it lacks grounds and content, thereby constituting absolute nullity.

The fifth ground of challenge concerns the failure to evaluate official letter MS-DPRSA-255-202027 of February 27, 2020, issued by the Ministerio de Salud. The plaintiff's representative explains that that document not only set forth the official position of the governing body on matters of public health, but also urged SETENA to properly exercise its powers and not to unlawfully self-limit those powers through an incorrect interpretation of an administrative resolution. The Ministerio de Salud concluded that it was not only viable to maintain the PTA Uruka project in the technical closure stage, but absolutely necessary in order to protect the national interest represented by health and the environment. The plaintiff states that what was ordered by the challenged resolution in its Por tanto — specifically, requesting that the Ministerio de Salud establish the parameters for technical closure with respect to elevation 985 msnm and conduct a new topographic survey — was unnecessary, incongruent, and unlawful, given that that Ministry had already issued an express and favorable opinion regarding the approved Technical Closure Plan. By failing to evaluate that report, the grounds and content of the challenged act are tainted with absolute nullity.

The sixth ground of challenge alleges that the challenged resolution disregarded the Technical Closure and Post-Closure Plan approved by Resolution No. 2628-2012-SETENA. The plaintiff explains that that plan already contemplated that during the technical closure stage the project must continue operating, since the costs of that process cannot be borne if the company has no income. By ignoring that precedent, the revocation act disregarded the fact that technical closure cannot be carried out if the project is not in operation.

The seventh ground of challenge alleges that the challenged resolution did not evaluate the actual status of the project at the time it was issued, given that by then the elevation had already exceeded 985 msnm, standing at 986.50 msnm according to the most recent survey by the Ministerio de Salud. In that context, ASOCARIARI's motion and the resolution that upheld it lacked a current legal interest, and the appropriate course of action would have been to reject and archive the motion pursuant to Article 275 of the Ley General de la Administración Pública. By failing to do so, the grounds of the act were inconsistent with reality, thereby also tainting its content and purpose.

The eighth ground of challenge concerns the fact that the technical closure project had already received the endorsements (visados) of the Ministerio de Salud and of the Colegio Federado de Ingenieros y Arquitectos, which evidenced that the competent authorities had approved the project having subjected it to their technical and legal review. The plaintiff also cites the jurisprudence of the Contraloría General de la República, which has recognized that the determination of the useful life of a landfill is a task that falls to the very operators of those facilities, who are the ones with thorough knowledge of their activities, since useful life is a variable factor over time that cannot be certified by any other authority.

Regarding the substantive claims, the plaintiff's representative requests that the Tribunal, by judgment, declare the substantial non-conformity with the legal order (disconformidad sustancial con el ordenamiento jurídico) and the consequent absolute nullity of Resolution No. 0320-2020-SETENA; that it likewise declare the absolute nullity of all acts connected to that formal conduct; and that in the event of opposition, the State be ordered to pay all costs of the proceeding together with the corresponding statutory interest calculated from the date on which the amount is definitively determined until actual payment.

In the written closing arguments submitted on December 18, 2020 by Licenciado Luis Lechtman Meltzer in his capacity as the plaintiff's special judicial attorney-in-fact, he maintains that the challenged resolution creates serious legal uncertainty for the development of the technical closure of the PTA Uruka project, since its content — contrary to the State's argument — does produce concrete and harmful legal effects that can only be annulled by the same body that created them or by a competent tribunal. He argues that the Procuraduría General de la República is not in a position to resolve that conflict and that only this Tribunal can declare the scope of the effects of the challenged resolution by judgment. He rejects the State's argument that the challenged resolution would not be an act susceptible to challenge, characterizing that position as simplistic and incorrect. He explains that said act revokes an environmental license granted to his principal and fixes the project's maximum capacity at elevation 985 msnm, which is tantamount to ordering its immediate and permanent closure, given that that elevation had already been exceeded in much of the project by the date of the challenged resolution. It is, therefore, an administrative act that causes extremely serious harm to the company and that is arbitrary and unlawful.

He further argues that the State's answer to the complaint amounts in practice to a tacit submission (allanamiento tácito), since the State acknowledges that fixing the project's maximum elevation is not SETENA's responsibility but rather that of the Ministerio de Salud. If that is the State's position, the consistent course of action would have been to formally submit to the claim and proceed to annul an act that maintained the contrary. The plaintiff notes that the new Resolution No. 0872-2020-SETENA, in which SETENA defers to the competence of the Ministerio de Salud and endorses Report MS-DPRSA-360-2020 of March 31, 2020, is further evidence that the Secretaría acknowledges the grave error committed in issuing the challenged resolution. That new report from the Ministerio de Salud ratified everything that his principal had been asserting: that the elevation increase was consistent with the technical studies, that it was necessary for the technical closure process, and that the closure had been carried out in a stable and successful manner for more than a year.

He notes that the purported justification for Resolution No. 0872-2020-SETENA — to the effect that the revocation of Resolution No. 2064-2019-SETENA was consistent with the legal order because that body lacked authority to authorize the elevation increase — is false and incorrect, given that the Ministerio de Salud itself, in Report MS-DPRSA-360-2020, states exactly the opposite: that the modification of the elevation was processed and approved in accordance with the law. He concludes that if the Ministerio de Salud endorsed that modification and SETENA now acknowledges this, there is no legal justification for maintaining Resolution No. 0320-2020-SETENA, whose incorrect and unlawful assertions cannot be allowed to stand.

Finally, the plaintiff's representative reiterates that the environmental viability granted by Resolution No. 2064-2019-SETENA was a requirement that the Ministerio de Salud itself demanded in order to endorse the plans for the technical closure project. Consequently, voiding that environmental viability without a judicial declaration to that effect creates a legal vacuum that exposes the company to the project's numerous adversaries, who could exploit the existence of contradictory administrative resolutions to challenge the permit granted by the Ministerio de Salud and to target the company's responsible officers and professionals. He affirms that in that context of legal uncertainty, if the challenged act remains in force, his principal would have no option but to close and abandon the PTA Uruka project, with the devastating sanitary and environmental consequences already described. For all these reasons, he requests that the Tribunal declare the nullity of the effects of Resolution No. 0320-2020-SETENA by judgment.

FIFTH. SUMMARY OF THE OPPOSITION. With the same clarification made with respect to the complaint brief — namely, that what follows is a summary and synthesis of what was stated by the party, but that all arguments will be analyzed as appropriate — the contentions raised by the State's representative are set out below. With regard to the facts alleged in the complaint, the State's representative accepts as true facts first through fourth, which concern the submission of the Preliminary Environmental Assessment Form for the project, the submission of the Environmental Impact Study, the approval of that study by Resolution No. 093-2000-SETENA, and the formal granting of environmental viability (Viabilidad Ambiental) by Resolution No. 652-2000-SETENA. With respect to the fifth fact, the representative partially accepts that an update to the Environmental Management Plan (Plan de Gestión Ambiental) was submitted, but rejects as inaccurate the stated date of July 30, 2012, clarifying that the update was submitted on February 27, 2012.

Facts sixth through eighth are accepted as true. With respect to the ninth fact, it is accepted, but the representative notes that it is not relevant to the resolution of the matter. Facts tenth and eleventh are partially accepted insofar as the resolutions of the Administrative Environmental Tribunal (Tribunal Ambiental Administrativo) exist, but the remainder is rejected as inaccurate on the ground that the transcriptions made by the plaintiff are partial and do not reflect the totality of what was decided; the representative likewise notes that those facts are not relevant to resolving the matter. The twelfth fact is rejected as inaccurate for the same reasons, and the State's representative clarifies in particular that Resolution No. 1364-18-TAA of the Administrative Environmental Tribunal ordered the Ministry of Health, in coordination with SETENA, to maintain strict oversight of the topographic measurements so that, once elevation level (cota) 985 m.a.s.l. was reached, technical instructions would be issued to proceed with the technical closure process.

Facts thirteenth and fourteenth are partially accepted. The fifteenth fact, referring to Resolution No. 2064-2019-SETENA, is rejected as inaccurate, and the State's representative clarifies that its significance is irrelevant to the resolution of the matter, since the approval of the Plan of Actions for the Operational Closure of the PTA Uruka falls within the exclusive and excluding competence of the Ministry of Health, and not of SETENA. The sixteenth fact is accepted as true, with the clarification that the Plan of Actions was approved by the Ministry of Health on November 1, 2019 and remains fully in force. Facts seventeenth and eighteenth are accepted. The nineteenth fact, relating to Resolution No. 0320-2020-SETENA, is partially accepted insofar as the existence of the resolution is concerned; the remainder is rejected as inaccurate, with the same clarification regarding the current validity of the Plan of Actions.

The twentieth fact is rejected on the ground that it does not constitute a fact in the technical legal sense but rather a subjective characterization. Finally, the twenty-first fact is rejected as inaccurate, the representative explaining that official communication MS-DPRSA-255-2020 of February 27, 2020 was issued by the Ministry of Health in response to a request from SETENA itself, and not in the terms presented by the plaintiff. In the legal grounds section, the State's representative develops its position starting from the background of the case. It notes that the plaintiff submitted to SETENA the Plan of Actions for the Operational Closure of the PTA Uruka on January 31, 2019, in which it expressly stated that the Environmental Management Plan did not contemplate new environmental measures, since the activity would not undergo any significant change. Despite this, and notwithstanding that the approval of that closure plan fell within the exclusive competence of the Ministry of Health, SETENA issued Resolution No. 2064-2019-SETENA approving the plan and setting an additional useful life of four years.

Dissatisfied with that act, Ms. Melissa Flores Núñez filed a motion for reconsideration (recurso de revocatoria) with a subsidiary appeal, and SETENA, upon resolving the motion by Resolution No. 0320-2020-SETENA, revoked Resolution No. 2064-2019-SETENA and requested that the Ministry of Health provide the technical information necessary to proceed with the analysis of the technical closure. The Ministry of Health responded through official communication MS-DPRSA-360-2020 of March 31, 2020, indicating that it was the sole competent body to grant approval of the closure plan and that it had already approved it on November 1, 2019 by means of the compliance report for project CFIA-884423, and that it could not prescribe new parameters in addition to those already established by the applicable regulations. In response, SETENA issued Resolution No. 0872-2020-SETENA at 13:00 hours on May 11, 2020, in which it determined that it is not the competent body to approve the technical closure plan, given that such competence rests exclusively with the Ministry of Health.

As its first substantive defense, the State's representative raises the exception of lack of current interest (falta de interés actual). It argues that Resolution No. 0320-2020-SETENA solely revoked Resolution No. 2064-2019-SETENA and requested information from the Ministry of Health in order subsequently to consider the closure plan; however, since the Ministry of Health indicated that the plan was already approved within its own competence, Resolution No. 0872-2020-SETENA was issued, in which SETENA acknowledged its lack of competence to rule on the matter. Consequently, the Plan of Actions for the Operational Closure of the PTA Uruka remains fully in force with the approval of the Ministry of Health, which demonstrates that no harm to the plaintiff's rights continues to exist. The State's representative invokes the jurisprudence of the First Chamber (Sala Primera) of the Supreme Court of Justice, which has established that lack of current interest is equivalent to an absence of legal basis for an annulment claim, given that no current or pending injury susceptible of remedy exists.

It concludes that the potential damages or risks invoked by the plaintiff are remote and hypothetical and do not constitute grounds for bringing a contentious-administrative action. As its second substantive argument, the State's representative rejects the plaintiff's assertion that Resolution No. 0320-2020-SETENA had revoked an environmental license or environmental viability. It notes that this assertion is incorrect, since the environmental viability of the project was granted by Resolution No. 652-2000-SETENA at 12:00 hours on July 18, 2000, which was not revoked. Resolution No. 2064-2019-SETENA did not constitute an environmental viability, but rather addressed the request for approval of the Closure Action Plan, which, it is reiterated, falls within the competence of the Ministry of Health and not SETENA. The State's representative indicates that the various stages in the operation of a sanitary landfill — opening, development, and closure — are assessed from the moment the environmental viability is granted, which is a prerequisite for the health operating permit (permiso sanitario de funcionamiento).

The technical closure is merely one of those stages, and its approval belongs to the Ministry of Health as the competent authority for the control and licensing of sanitary landfills. In support of this thesis, the State's representative invokes Article 7 of the Law for Integrated Waste Management (Ley para la Gestión Integral de Residuos), No. 8839, which designates the head of the Ministry of Health as the sector's governing authority, with powers of direction, monitoring, evaluation, and control; and Articles 8 through 13 of Decreto Ejecutivo No. 38928-S, Regulations on Sanitary Landfills (Reglamento sobre Rellenos Sanitarios), from which it follows that all proceedings before the Ministry of Health — location permit, review of construction plans, and health operating permit — fall within that institution's competence. It further emphasizes that no provision of the legal order establishes that the technical closure of a sanitary landfill requires an additional environmental viability granted by SETENA, as the plaintiff erroneously interprets.

It concludes that Resolution No. 0872-2020-SETENA, by correcting the error into which SETENA fell when it ruled on a matter beyond its competence, is consistent with the law and does not affect the plaintiff's subjective rights, since the approval of the Closure Plan had already been granted by the competent authority as of November 1, 2019. In its written closing submissions, the State's representative elaborates its position in greater detail under two main argumentative headings: inadmissibility of the complaint and lack of merit on the substance. With respect to inadmissibility, it reiterates that Resolution No. 0320-2020-SETENA is, strictly speaking, a procedural interlocutory act (acto de mero trámite) whose sole effect was to revoke Resolution No. 2064-2019-SETENA and to request information from the Ministry of Health in order to rule subsequently on the technical closure plan. It maintains that this act has no independent effect and does not generate a definitive legal situation, so that any challenge to its annulment could only have been brought together with final Resolution No. 0872-2020-SETENA, in which SETENA definitively declared itself without competence in the matter.

However, the plaintiff did not challenge the latter resolution, a choice made by the plaintiff herself that the Tribunal cannot supply on her behalf. It cites jurisprudence of the Administrative Court (Tribunal Contencioso Administrativo) establishing that an interlocutory act cannot be challenged independently in the contentious-administrative forum, but only when it causes a denial of due process or decides the merits of the matter — circumstances that are not present here. On the merits, the State's representative insists that no current harm to the plaintiff's rights exists. It invokes the content of official communication MS-DPRSA-360-2020 of March 31, 2020 from the Ministry of Health, submitted by the State itself in these proceedings, which confirmed that the technical closure plan for the PTA Uruka had already been approved within the Ministry's competence since November 1, 2019.

It adds that Resolution No. 0872-2020-SETENA, by acknowledging SETENA's lack of competence to assess the elevation of the waste disposal level and to approve the technical closure, does nothing other than correct the error of Resolution No. 2064-2019-SETENA, which had ruled on a matter outside its legal competences. It highlights that the plaintiff herself did not challenge Resolution No. 0872-2020-SETENA, which demonstrates that she recognized that act to be lawful and not injurious to her rights. In that regard, the continued existence of the Plan of Actions approved by the Ministry of Health renders the hypothetical harms invoked by the plaintiff — forced closure, sanitary collapse, impact on fifteen municipalities — conjectural and lacking the degree of immediacy required by jurisprudence to sustain a contentious-administrative action. Finally, with respect to the plaintiff's thesis that the environmental viability granted by Resolution No. 2064-2019-SETENA was a prerequisite that the Ministry of Health required for endorsing the plans of the technical closure project, the State's representative notes that this is an error on the plaintiff's part.

Article 10, paragraph (e), of Decreto Ejecutivo No. 38928-S requires an environmental viability as a prerequisite for the location permit, and the project has had one since the year 2000. No regulatory provision makes it mandatory to obtain an additional environmental viability in order to proceed with the technical closure stage; accordingly, the plaintiff's thesis lacks any legal basis. It therefore requests that the complaint be declared inadmissible, and, subsidiarily, that the exceptions of lack of current interest, lack of legal right, and lack of standing (falta de legitimación) be sustained, with a consequent order that the plaintiff bear the costs of the proceedings.

SIXTH. DEFENSE OF NON-REVIEWABLE ACT. Before entering into the analysis of the merits, it is necessary to explain why this defense is examined first and with priority over every other litigated issue. The defense of non-reviewable act has the character of a procedural bar (carácter procesal impeditivo): if it were to prevail, the Tribunal would be prevented from ruling on the merits of the matter, which would result in a judgment of an inhibitory nature declaring the complaint inadmissible, with no possibility of examining the nullity defects invoked by the plaintiff. That bar-like character determines its priority consideration and equally requires that it be examined fully. A. Position of the parties. The State's representative invokes the inadmissibility of the proceedings on the ground that the formal conduct challenged — Resolution No. 0320-2020-SETENA at 10:00 hours on February 21, 2020 — constitutes a procedural interlocutory act that neither creates a final determination nor produces an independent definitive effect within the legal order.

Its position rests on the contention that the challenged act was limited to resolving a motion for reconsideration filed by a third party, ordering the revocation of Resolution No. 2064-2019-SETENA and reserving consideration of the closure plan until the Ministry of Health issued the corresponding technical parameters. According to the State's thesis, the final act of the procedure is the subsequent Resolution No. 0872-2020-SETENA, in which SETENA (Secretaría Técnica Nacional Ambiental) deferred to the competences of the Ministry of Health, so that the complaint fails to meet the requirements of Article 36, paragraph (c), of the Code of Administrative Contentious Procedure (Código Procesal Contencioso Administrativo, CPCA). The plaintiff company categorically contests that legal characterization. It argues that Resolution No. 0320-2020-SETENA cannot be classified as a procedural interlocutory act, because: it directly revoked a favorable act that recognized the conditions of viability for the technical closure; it established an operational limit that, by the date the act was issued, had already been exceeded in practice, effectively amounting to an implicit order of immediate cessation; and that, despite the issuance of Resolution No. 0872-2020-SETENA, the revocation that had been effected was never formally set aside.

It submits, in sum, that the challenged act directly and independently caused it a grave and substantial injury, endowing it with independent effects that are fully subject to judicial review. B. Tribunal's reasoning. The standard of review for resolving this defense is found in Article 36, paragraph (c), of the Code of Administrative Contentious Procedure (Law No. 8508), a provision that states clearly that an administrative claim shall be admissible against administrative acts "whether final, definitive, or interlocutory acts with independent effect." National legal doctrine and the consistent jurisprudence of the First Chamber of the Supreme Court of Justice have established that the so-called interlocutory act with independent effect — or qualified interlocutory act (acto de trámite cualificado) — is one that, although issued in an intermediate stage within the sequence of a formal procedure, directly, substantially, and irreversibly affects the legal sphere of the person subject to administrative authority: it predetermines the outcome of the final ruling, extinguishes legitimate rights, creates an irreparable denial of due process, or imposes a burden that cannot be remedied even by the issuance of the closing act.

The rationale behind that normative category lies in preventing the Administration from using the conceptual shield of the "interlocutory" label to deploy formal conduct capable of consummating irreparable harm without the affected person being able to seek timely judicial protection. With that standard in mind, it is now necessary to analyze whether Resolution No. 0320-2020-SETENA constitutes a mere interlocutory act without independent effect, as the State contends, or whether, on the contrary, it possesses the characteristics of a qualified interlocutory act with independent and autonomous effects. The Tribunal concludes, on the basis of five reasons set out below, that the defense raised lacks any legal foundation and must be rejected. i. Resolution No. 0320-2020-SETENA produced an autonomous and immediate ablative effect (efecto ablatorio): the revocation of the pre-existing favorable act.

At the time the challenged act was issued, the plaintiff company held a right formalized by Resolution No. 2064-2019-SETENA at fourteen hours on June 28, 2019. That act approved the "Plan of Actions for the Operational Closure of the PTA URUKA" and, on the basis of slope-stability technical studies prepared by the firm INSUMA S.A., recognized an elevation level of up to 995 m.a.s.l. as a technically viable condition for carrying out the technical closure ordered over a period of four years. In its Por Tanto Primero, Resolution No. 0320-2020-SETENA ordered the total revocation of that approving act. That revocation constituted a complete, autonomous, and immediate ablative effect: at the precise moment the challenged act was notified, Resolution No. 2064-2019-SETENA ceased to exist as a matter of law and the company was stripped of the legal coverage under which it had been executing the technical closure process.

This was not a neutral step within a procedure: an act that recognized subjective rights and established specific operating conditions for a high-impact, public-interest activity was extinguished at its root. The revocation was not conditioned on the obtaining of further information nor subordinated to the issuance of any subsequent act; it was definitive and immediate from the moment of its adoption. That extinction of prior legal protection constitutes, in itself, an independent effect of the first order. ii. The implicit mandate to comply with elevation level 985 m.a.s.l. was, in operational terms, equivalent to an immediate order to cease operations. The Por Tanto Segundo of Resolution No. 0320-2020-SETENA ordered the Ministry of Health to establish the technical closure parameters "with respect to elevation level 985 m.a.s.l.", to indicate the new guidelines for the Closure Plan, and to conduct a topographic survey of the maximum elevation of the landfill.

That provision, considered together with the technical context established in the record, produced an independent effect. As shown by the documentary evidence incorporated into the case file — in particular, Report SETENA-DT-ASA-1618-2019 of SETENA's own Environmental Audit and Monitoring Department — by the date the challenged act was issued, sanitary landfill PTA Uruka was already operating at elevations above 985 m.a.s.l. That level had originally been set in the rulings of the Administrative Environmental Tribunal on the basis of a self-imposed limitation by the company itself at a time when it had less technical information available; it was not the product of load-bearing capacity studies by any public authority. Subsequent studies by INSUMA S.A. demonstrated that the landfill could safely reach 995 m.a.s.l., a conclusion endorsed by the Ministry of Health through the APC platform of the Colegio Federado de Ingenieros y Arquitectos as of November 1, 2019.

Compelling the company to conform, immediately, to a topographic limit already physically exceeded was, in practice, equivalent to ordering the forced, immediate, and definitive cessation of the reception of solid waste, without the logistical support of the technically endorsed upper terraces. That effect of actual operational paralysis — concrete and independent — is an independent effect of the challenged act that materialized upon its mere notification, regardless of any subsequent ruling. iii. The Por Tanto Segundo conditioned the future conduct of the Ministry of Health within a predetermined framework, thereby producing independent effects upon a body with independent competence. A third independent effect becomes apparent upon examining the actual scope of the Por Tanto Segundo of Resolution No. 0320-2020-SETENA: the instruction to the Ministry of Health to establish the technical closure parameters "with respect to elevation level 985 m.a.s.l." was not an open consultation or an unconditional referral to that Ministry's competences.

It was an instruction that anticipatorily bound the action of a body with its own independent competence to a legal premise that was not put to it for discussion: the inviolability of elevation level 985 m.a.s.l. as an absolute limit. A mere interlocutory act cannot, by definition, condition or predetermine the future conduct of another body vested with exclusive competences. What SETENA did through the Por Tanto Segundo was precisely that: it established a prior and binding legal framework within which the Ministry of Health was compelled to exercise its own powers. That effect on the sphere of action of an institutional third party, beyond the sphere of the plaintiff company, confirms that the challenged act far exceeds the nature of a simple procedural step. iv. Resolution No. 0872-2020-SETENA does not constitute the "final act of the procedure" within the normative meaning of Article 36, paragraph (c), of the CPCA.

The State maintains that the final act of the procedure was Resolution No. 0872-2020-SETENA, and that it was that act which should have been challenged. That argument does not withstand scrutiny against the text of that resolution. Its Por Tanto Primero merely records that notice was taken of the Ministry of Health's report (official communication MS-DPRSA-360-2020 of March 31, 2020). Its Por Tanto Segundo provides that SETENA "defers to and submits to the powers and competences invoked by the Ministry of Health in the said report, without prejudice to the oversight powers that are inherent to the Secretariat." That resolution did not resolve the plaintiff company's request for approval of the Closure Plan. It neither approved nor rejected that plan. It simply declared that the competence to approve it belonged to the Ministry of Health — a competence that, it should be noted, the Ministry had already exercised on November 1, 2019 — and refrained from ruling on the merits for lack of competence.

An act that declares a lack of competence and abstains from deciding the substantive issue is not the "final act" of a procedure in the technical sense of Article 36, paragraph (c), of the CPCA. The final act is the one that decides the merits of the matter that was under discussion. Resolution No. 0872-2020-SETENA did not do so. Resolution No. 0320-2020-SETENA, by contrast, did decide: it revoked rights and imposed an operational limit with immediate consequences. It was that resolution — and not the subsequent one — that bore the character of an autonomous decisive act subject to judicial review. It should be added that Resolution No. 0872-2020-SETENA did not annul or set aside Resolution No. 0320-2020-SETENA. The revocation effected by the latter remained in force as a formal legal declaration. The legal uncertainty that resulted for the plaintiff company had already produced real and irreversible effects before Resolution No. 0872-2020-SETENA was even issued. v. SETENA itself made ordinary remedies available against Resolution No. 0320-2020-SETENA.

The most compelling argument against the State's thesis comes from the text of the very act that the State seeks to shield from judicial review. The Por Tanto Octavo of Resolution No. 0320-2020-SETENA provided, verbatim: "Against this Resolution, ordinary remedies of reconsideration before SETENA and of appeal before the Minister of Environment and Energy may be filed within a period of three business days counted from the day following notification, in accordance with Articles 342 and following of the General Law of Public Administration and Article 87 of the Organic Law of the Environment." That provision is of a legal significance that cannot be ignored. Purely interlocutory acts are not subject to independent challenge precisely because they lack independent effects. Article 345 of the General Law of Public Administration (Ley General de la Administración Pública) reserves ordinary remedies for the act that initiates the procedure, the act that denies evidence, and the final act.

By expressly making those remedies available against Resolution No. 0320-2020-SETENA — with the three-day period that the legal order reserves for final acts — SETENA itself recognized at that time that the resolution produced independent effects and was capable of causing direct harm to the person subject to administrative authority. It should be noted in advance that the plaintiff company did in fact file a motion for reconsideration against Resolution No. 0320-2020-SETENA, and that it was declared inadmissible by Resolution No. 0794-2020-SETENA. It might be argued that that declaration of inadmissibility contradicts the acknowledgment of reviewability contained in the Por Tanto Octavo. However, examination of Resolution No. 0794-2020-SETENA reveals that the rejection of the plaintiff's motion was not based on the act lacking independent effects, but rather on a completely different technical-procedural ground: that the resolution deciding a motion for reconsideration is itself not subject to a further motion for reconsideration, pursuant to Article 345 of the General Law of Public Administration, since the recourse phase had been exhausted with the issuance of Resolution No. 0320-2020.

Non-reviewability in the administrative forum due to exhaustion of the remedial process is a legal category radically different from the absence of independent effects. The former closes the administrative avenue; the latter closes the judicial avenue as well. SETENA effected the former; the State seeks the latter before this Tribunal. This distinction is decisive. Precisely because the administrative avenue was exhausted with the issuance of Resolution No. 0320-2020-SETENA, the plaintiff company was entitled to resort to the contentious-administrative forum, which is exactly what it did by filing the present complaint. The rejection of the motion by Resolution No. 0794-2020 does not undermine, but rather confirms, that Resolution No. 0320-2020-SETENA was the act with independent effects that put an end to the administrative avenue and opened the door to judicial protection. SETENA made ordinary remedies available against that act, thereby acknowledging its capacity to produce independent effects; it then, upon rejecting the plaintiff's motion, found that those independent effects had already exhausted the administrative avenue; and the State now contends before this Tribunal that that same act lacked independent effects.

That threefold contradiction cannot prevail, and this Tribunal does not endorse it. C. Conclusion: Having examined the five foregoing reasons, this Tribunal concludes, without any doubt, that Resolution No. 0320-2020-SETENA does not constitute a mere interlocutory act without independent effect. On the contrary, it cumulatively possesses the attributes of a qualified interlocutory act with independent and autonomous effects: it produced an immediate ablative revocation of pre-existing subjective rights; it imposed a de facto operational paralysis order; it conditioned the conduct of another body with its own competence; it was the only act with real decisive effect in the procedural sequence; and it was characterized as a final act subject to remedies by the very administrative body that issued it. The defense of inadmissibility raised by the State therefore lacks any legal foundation and must be rejected, as it hereby is.

SEVENTH. PLEA OF LACK OF CURRENT LEGAL INTEREST. The plea of lack of current legal interest (interés actual) raised by the State shares with the defense resolved in the preceding considerando its nature as a procedural bar: if sustained, it would prevent the Tribunal from ruling on the merits of the matter and would give rise to a judgment of inadmissibility. However, it presents a technical particularity that distinguishes it from that defense: the presence of current legal interest is not merely an admissibility requirement that must be satisfied at the time of filing the complaint, but a procedural prerequisite that must be maintained throughout the entire course of the proceedings and that the adjudicator is empowered, and obligated, to examine sua sponte at any procedural stage, including at the moment of rendering judgment. This has been established repeatedly by the Sala Primera of the Supreme Court of Justice, and it is confirmed by the very jurisprudence that the State invokes in its favor. The Tribunal addresses this plea at this juncture for reasons of procedural economy and in accordance with the logic of the argumentative progression.

A. The State's Position. The State's representation structures its plea on three linked premises. The first is jurisprudential in nature: invoking sentencia N.° 708-F-S1-2016 of 8:30 a.m. on June 30, 2016, of the Sala Primera of the Supreme Court of Justice, it asserts that current legal interest requires that the annulment of the challenged act yield a direct, real, and concrete benefit to the claimant; that such benefit does not materialize if the absence of a judgment causes no harm or prejudice whatsoever; and that the so-called mere interest in the abstract legality of the administrative act is not legally protectable. The second premise is factual: the Plan of Actions for the Operational Closure (Plan de Acciones para el Cierre Operativo) of the PTA Uruka was already approved by the Ministry of Health — which the State identifies as the sole competent authority on the matter — by means of a compliance report issued on November 1, 2019, through the APC platform of the Colegio Federado de Ingenieros y Arquitectos (project CFIA-884423 "Cierre Técnico Operativo PTA Uruca"), even before the issuance of Resolución N.° 0320-2020-SETENA.

The third premise is one of legal consequence: Resolución N.° 0872-2020-SETENA acknowledged that competence of the Ministry of Health and explicitly deferred to it. This being so, the plaintiff company already holds the approval of the only competent authority to endorse its technical closure plan, and therefore no harm or prejudice persists within its legal sphere that could be removed by an annulatory judgment against Resolución N.° 0320-2020-SETENA. The plaintiff accordingly lacks current legal interest, and the complaint must be declared inadmissible.

B. The Tribunal's Ruling. This Chamber adopts the jurisprudential framework cited by the State as the correct standard for resolving this plea, since that same jurisprudence, correctly applied, leads to the opposite conclusion from the one the State seeks. The Sala Primera, in the decisions invoked — among them N.° 708-F-S1-2016, N.° 1023-F-S1-2009, N.° 900-F-S1-2011, and N.° 528-F-S1-2011 — has defined current legal interest as the need for judicial protection in which a specific individual finds themselves, determined by the non-satisfaction of a legitimate interest (interés legítimo) or a vested right (derecho subjetivo), which motivates them to seek judicial intervention. For that interest to be legally protectable, it must meet four characteristics: that the annulment of the act produce a direct benefit for the claimant by eliminating a harmful act; that the impact of that annulment be direct and immediate upon the claimant's legal situation; that it be personal and concrete to the challenger; and that it be current and certain — existing at the time of the complaint and throughout the entire proceedings — whether because harm has already occurred or because it is foreseeable under the normal circumstances of the case.

The central criterion established by the Sala Primera for the utility assessment is the following: if the absence of a judgment produces harm or prejudice to the party that sought judicial protection, there is interest; if it does not, there is none. Applied to the present case, this standard leads to an unequivocal conclusion: the plaintiff company does suffer a current and concrete prejudice from the continued effect of Resolución N.° 0320-2020-SETENA, and a judicial declaration of its nullity would indeed produce a direct and immediate benefit to it. The reasons supporting that conclusion are set out below.

i. The vested right extinguished by Resolución N.° 0320-2020-SETENA was not restored by any subsequent act, and its restoration constitutes the proper object of the annulatory claim. Resolución N.° 2064-2019-SETENA conferred upon the plaintiff company a vested right of complex and specific content: it approved in its entirety the Plan of Actions for the Operational Closure of the PTA Uruka, including the construction plans CFIA-884423; it technically validated the elevation (cota) of 995 m.a.s.l. as a viable operational parameter for the closure; and it determined a remaining useful life (vida útil) of four years within which to carry out said closure. That set of determinations did not constitute a mere expectation or a provisional authorization, but rather a formal approving act, issued by the body with competence in environmental management, grounded in slope stability (estabilidad de taludes) technical studies prepared by the firm INSUMA S.A. and in a field inspection, within the administrative case file (expediente administrativo) for the Environmental Impact Assessment (evaluación de impacto ambiental, EIA) N.° FEAP-718-1998-SETENA.

The Por Tanto Primero of Resolución N.° 0320-2020-SETENA revoked that act in its entirety, expressly, immediately, and unconditionally. This was not a suspension or a partial modification. The legal environmental backing under which the company was executing its closure plan was completely eliminated. That revocation remained, and still remains, as a formal legally binding declaration in effect, without any subsequent act having rendered it void, either explicitly or implicitly. Resolución N.° 0872-2020-SETENA, which the State presents as the act that neutralized the effects of Resolución N.° 0320-2020, did not in any way restore the extinguished vested right. Its only two operative clauses are: to take note of the Ministry of Health's report (Por Tanto Primero) and to declare that SETENA defers to that Ministry's authority in the technical closure procedure (Por Tanto Segundo). Neither of those operative clauses revokes, annuls, voids, or substitutes the revocation contained in Resolución N.° 2064-2019-SETENA.

Resolución N.° 0872-2020 did not approve EBI's Plan of Actions. It did not recognize the elevation of 995 m.a.s.l. as a valid parameter. It did not determine any useful life. It simply declined to rule on the merits for lack of competence, and acknowledged that such a ruling belonged to another body. Consequently, the plaintiff company currently lacks a valid environmental legal title on file with SETENA to support its technical closure plan at the approved elevation. The only path to restoring that title is a judicial declaration of nullity of Resolución N.° 0320-2020-SETENA, which would operate retroactively to restore the legal effect of Resolución N.° 2064-2019-SETENA. That direct, concrete, and personal utility is, in itself, the current legal interest that makes the complaint viable.

ii. The Ministry of Health's approval via the APC platform is neither equivalent to nor a substitute for the environmental legal title derived from Resolución N.° 2064-2019-SETENA. The State's central argument rests on a premise of equivalence that has no basis in the legal order: that the Ministry of Health's approval through the CFIA's APC platform covers the same subject matter as Resolución N.° 2064-2019-SETENA and that, therefore, the revocation of the latter causes no prejudice whatsoever to the plaintiff. That equivalence does not exist. The compliance report issued by the Ministry of Health on November 1, 2019 (project CFIA-884423) endorsed the construction plans for the technical operational closure from the standpoint of that Ministry's own competences in public health and construction works, within the framework of the Reglamento sobre Rellenos Sanitarios (Decreto Ejecutivo N.° 38928-S) and the Ley General de Salud.

Resolución N.° 2064-2019-SETENA, by contrast, approved the Plan of Actions as an environmental management instrument for the project, within the Environmental Impact Assessment case file held by SETENA and in the exercise of the powers that Article 19 of the Ley Orgánica del Ambiente N.° 7554 and Decreto Ejecutivo N.° 31849-MINAE-S-MOPT-MAG-MEIC vest in that Secretariat. The two legal approvals operate under different regulatory frameworks, derive from authorities with non-overlapping competences, and cover different aspects of the same activity. The Por Tanto Tercero of Resolución N.° 2064-2019-SETENA itself acknowledged the coexistence of both competences by ordering notification of the approval to the Ministry of Health so that, based on its own competences, that Ministry could consider the proposed works during the closure process and report any observations. Had the two competences been the same, or had one subsumed the other, that notification would have been superfluous.

It was not. The plaintiff company requires both legal titles to operate in full compliance with the legal order, and the revocation of one of them (that of SETENA) cannot be remedied by the continued existence of the other.

iii. The formal continued effect of the revocation itself generates a state of legal uncertainty that constitutes a current, direct, and concrete prejudice. Even assuming hypothetically (which this Tribunal does not accept) that the Ministry of Health's approval provides sufficient operational coverage for the technical closure of the PTA Uruka, an autonomous, current, and concrete prejudice would still exist, derived from the formal continued effect of the revocation carried out by Resolución N.° 0320-2020-SETENA: the company operates in a state of legal uncertainty regarding the permissible elevation parameters under SETENA's framework, because the only act that had established those parameters with approving force in that case file was revoked and never reinstated. That uncertainty is neither hypothetical nor remote. Resolución N.° 0872-2020-SETENA itself expressly reserved "the oversight powers inherent to the Secretariat" (Por Tanto, Segundo).

This means that SETENA reserved the authority to monitor and follow up on the execution of the technical closure, regardless of whether the approval competence was recognized in the Ministry of Health. In the exercise of those oversight powers, any future monitoring or supervisory action taken by SETENA could invoke the continued effect of the revocation to challenge operations carried out under the parameters that Resolución N.° 2064-2019-SETENA had validated. The company cannot invoke that revoked act as a legal shield. The legal insecurity arising therefrom — which will persist for as long as the revocation is not judicially annulled — is a real and present harm suffered by the company, and it is precisely what the annulatory judgment is called upon to remove.

iv. The State's position is internally contradictory: the very argumentation that purports to establish the lack of interest confirms its existence. There is an insurmountable logical contradiction in the State's procedural position that, by itself, reveals the inconsistency of the plea. Throughout its answer and closing arguments, the State simultaneously maintains two incompatible propositions. On the one hand, in its first defensive argument — resolved in the preceding considerando — the State asserts that Resolución N.° 0320-2020-SETENA is a purely procedural act (acto de mero trámite) with no effects of its own. If that proposition were true, the act would have produced no change in the plaintiff's legal sphere: it would not have extinguished any rights, it would not have created any uncertainty, it would not have generated any prejudice whatsoever. Under that scenario, there would also be nothing to "overcome" and no interest — not even a potential one — that could be affected by the continued effect of that act.

On the other hand, and in the same case file, the State devotes entire pages of its answer and closing arguments to arguing that the plaintiff lacks current legal interest because that same act was overcome by Resolución N.° 0872-2020-SETENA and by the Ministry of Health's approval. But for an act to be "overcome," it must have produced effects that required neutralization by subsequent acts. Had Resolución N.° 0320-2020 produced no effects of its own, there would have been nothing to overcome, and Resolución N.° 0872-2020 would have been unnecessary. The two theses cannot coexist. Either Resolución N.° 0320-2020-SETENA lacked effects of its own — in which case no interest ever arose or disappeared, rendering the plea of lack of current legal interest incongruous — or it did produce effects of its own upon the plaintiff's legal sphere — in which case the defense addressed in the preceding considerando fails, and the plaintiff's current legal interest in obtaining its annulment is self-evident.

The State cannot adopt a position that negates what the other affirms. That intrinsic contradiction confirms, by way of negation, that the plaintiff company does have current legal interest in the annulment of the challenged act.

C. Conclusion. Applying the utility assessment standard established by the Sala Primera's own jurisprudence, the conclusion is clear: the absence of a judgment does in fact produce harm and prejudice to the plaintiff company. The revocation carried out by Resolución N.° 0320-2020-SETENA extinguished vested rights derived from Resolución N.° 2064-2019-SETENA that were not restored by any subsequent act; the Ministry of Health's approval through the APC platform does not substitute the revoked environmental legal title in SETENA's case file; the formal continued effect of that revocation generates a state of legal uncertainty that constitutes a current, direct, and concrete prejudice; and the State's own argumentation incurs an internal contradiction that confirms the existence of the very interest it purports to deny. The plea of lack of current legal interest has no merit and must be rejected. Accordingly, the Tribunal proceeds to examine the grounds of nullity invoked against Resolución N.° 0320-2020-SETENA in the considerandos that follow.

EIGHTH. SUBSTANTIVE ANALYSIS: GROUNDS FOR ABSOLUTE NULLITY (nulidad absoluta) OF RESOLUTION N.° 0320-2020-SETENA. Having dismissed the procedural defenses, this court must now examine the substantive validity of the resolution challenged in these proceedings. Before turning to each defect, it is necessary to note that the State did not contest the substantive defects invoked by the plaintiff from its own technical or evidentiary standpoint. Its statement of defense and closing arguments focused on two arguments: that the challenged act was a mere procedural act with no independent effect, and that Resolution N.° 0872-2020-SETENA and the Ministerio de Salud's approval had rendered any defect irrelevant. Both arguments have been rejected in the preceding recitals.

Having neither submitted evidence nor advanced any independent technical argument to rebut the specific defects alleged in the complaint, the State left uncontradicted the facts underlying those defects. The only substantive defense that the State did develop with some degree of depth—and which coincides with the central argumentative thread of the challenged act itself—is the thesis of mandatory compliance with the resolutions of the Tribunal Ambiental Administrativo. That thesis is also the principal argument of Resolution N.° 0320-2020-SETENA itself, as evidenced in its recitals. For that reason, the analysis begins there, since its rejection brings down the legal foundation of all other elements of the act. Once the defects have been identified, they will be examined in the following order: first, the error of law in the grounds (motivo), based on SETENA's improper attribution of powers not belonging to the Tribunal Ambiental Administrativo; second, the error of fact in the grounds based on the omission of Report SETENA-DT-ASA-1618-2019; and third, the defect in the content (contenido) due to material impossibility of execution.

A. Applicable legal framework: elements of the administrative act and the nullity regime. An administrative act (acto administrativo), in order to be valid, requires that its essential elements be legitimate and in conformity with the legal order. As relevant to this case, Article 133 of the General Law of Public Administration (Ley General de la Administración Pública, LGAP) establishes that the grounds must be legitimate and must exist as they were taken into account when issuing the act; when not regulated, the grounds must be proportionate to the content. Article 132 provides that the content must be lawful, possible, clear, and precise. Article 131 requires that the purpose (fin) be a matter of public interest and correspond to that established in the norm conferring jurisdiction. Article 136 regulates the statement of reasons (motivación) as a formal duty to externalize the factual and legal reasons that determined the issuance of the act.

The concurrence of serious defects in any of these elements results in the absolute nullity of the act pursuant to Articles 158 and 166 of the same law, with retroactive effect from the date of its issuance.

B. Defect in the grounds. Error of law: SETENA improperly attributed to the Tribunal Ambiental Administrativo powers that do not belong to it, and incorrectly interpreted its Resolutions N.° 1364-18-TAA and N.° 461-19-TAA. The recital of Resolution N.° 0320-2020-SETENA that sustains the revocation of Resolution N.° 2064-2019-SETENA rests upon a single and central legal premise: that Resolutions N.° 1364-18-TAA of December 13, 2018, and N.° 461-19-TAA of March 25, 2019, issued by the Tribunal Ambiental Administrativo, ordered SETENA to treat the elevation (cota) of 985 m.a.s.l. as a definitive, absolute, and insurmountable limit for the project, against which no subsequent technical modification was permissible. In the words of the challenged act itself: "(...) This matter is not technical but one of legality, in which, following an ordinary proceeding, the Tribunal Ambiental Administrativo issued a resolution fixing the elevation for the commencement of the technical closure (cierre técnico) of the Parque de Tecnología Ambiental La Uruka at 985 m.a.s.l., which SETENA must jointly monitor with the Ministerio de Salud.

The resolution is a final and definitive act; therefore, at this stage it is not appropriate for SETENA to enter into discussion of its technical content, but rather to comply with it as mandatory, being compelled to do so." That premise is incorrect from both a normative and a textual-interpretive standpoint. With respect to the former, Article 111 of Organic Environmental Law (Ley Orgánica del Ambiente) N.° 7554 exhaustively defines the powers of the Tribunal Ambiental Administrativo: to hear and resolve complaints for violations of environmental protection legislation, to process complaints filed ex officio or by a party for active or omissive conduct that violates or threatens to violate that legislation, to award compensation for environmental damages, and to impose fines for infractions. Those are the only powers that the legal order confers upon it. Neither that provision nor any other in environmental law grants the Tribunal Ambiental Administrativo any authority to approve, deny, modify, or restrict projects subject to environmental impact assessment (evaluación de impacto ambiental, EIA), their addenda (adenda), their expansions, or their technical closure plans.

That authority belongs exclusively to SETENA, pursuant to Articles 17 and 83 of the Ley Orgánica del Ambiente, and, in matters of public health, to the Ministerio de Salud. The Tribunal Ambiental Administrativo is a complaint-resolution body; it is not an environmental management body and cannot act as such. A resolution of the Tribunal Ambiental Administrativo, however binding it may be within its own sphere, cannot create by interpretation a technical restriction not established by the legal order, nor can it confer upon that body a power that the law does not grant it. When SETENA concluded that the TAA had fixed the elevation of 985 m.a.s.l. as an insurmountable legal limit, it completely lost sight of that body's jurisdictional boundaries and confused the object of a sanctioning resolution with that of a technical-environmental authorization. That error of law tainted the grounds of the act from the outset.

Beyond the foregoing, even setting aside the jurisdictional argument, an analysis of the text of the Tribunal Ambiental Administrativo's own resolutions reveals that SETENA's reading of them is incorrect. Resolution N.° 1364-18-TAA of December 13, 2018 ordered the Ministerio de Salud, in coordination with SETENA, to "maintain strict oversight of the topographic measurement, so that once the elevation of 985 m.a.s.l. is reached, the technical instructions are issued for proceeding with the technical closure process, as the law requires." The final clause is the one SETENA overlooked: "as the law requires." That expression is not a rhetorical flourish; it is an express reference to the ordinary legal framework governing jurisdiction. The TAA did not order that the closure be carried out with the elevation of 985 m.a.s.l. as an immovable technical limit. What it directed was that, once that elevation was reached—which had been the planning benchmark that the company itself had self-imposed—the technical closure process should proceed in accordance with the applicable legal order. The manner of doing so was precisely the technical matter within the competence of SETENA and the Ministerio de Salud.

Resolution N.° 461-19-TAA of March 25, 2019 was even more explicit. When resolving the company's request for addition and clarification, the Tribunal Ambiental Administrativo stated: "(...) Although it is true that an elevation of 985 m.a.s.l. exists as the limit for proceeding with the technical closure... it was duly established... that the maximum elevation of the project may vary, in accordance with the procedures established for that purpose..." That express acknowledgment by the TAA—that the elevation could vary according to the legally prescribed procedures—is absolutely incompatible with the reading SETENA made in Resolution N.° 0320-2020. SETENA had that text before it. The very Sixth Recital of the challenged act cites Resolution N.° 1364-18-TAA. Nevertheless, it chose to ignore the clause "as the law requires" and the TAA's declaration regarding the variability of the elevation, and built its reasoning upon a reading that neither of those texts authorizes.

The error of law in the grounds is thus doubly demonstrated: SETENA invoked as the legal basis of its act a power the TAA does not possess, and attributed to the resolutions of that Tribunal a prohibitive scope that their own texts expressly deny. That defect is serious, indefeasible, and renders the grounds illegitimate pursuant to Article 133, paragraph 1, of the LGAP.

C. Defect in the grounds. Error of fact: omission of Report SETENA-DT-ASA-1618-2019. There is a second defect in the grounds, independent of the foregoing and of equal gravity, which arises from the internal procedural sequence of SETENA itself. On December 2, 2019, the Departamento Legal of SETENA, by means of official communication SETENA-AJ-0712-2019, expressly requested the Departamento de Auditoría y Seguimiento Ambiental to issue a technical opinion for the purpose of resolving the petition for revocation (recurso de revocatoria) filed by Ms. Melissa Flores Núñez against Resolution N.° 2064-2019-SETENA. That request for an opinion is recorded in the proven facts of this judgment and was acknowledged by Resolution N.° 0320-2020-SETENA itself in its Twelfth Recital.

The Departamento de Auditoría y Seguimiento Ambiental complied with that request and issued Report SETENA-DT-ASA-1618-2019 on December 13, 2019, signed by Acting Coordinator Eng. Alejandro González Barquero and environmental specialist M.Sc. Eng. Oscar Umaña Fernández. Its conclusions were as follows: first, the elevation of 985 m.a.s.l. was self-imposed by the developer based on the technical information available at the time and was not established by any governmental body as the result of a load-bearing capacity study; second, the increase to 995 m.a.s.l. arose from the technical studies carried out by INSUMA S.A., which determined, with an adequate safety factor and without risk to the stability of the sanitary landfill (relleno sanitario), that the height could be modified to that elevation; third, the receiving capacity of a sanitary landfill is variable and depends on multiple factors requiring ongoing studies; fourth, the elevation of 985 m.a.s.l. was an internal planning measure in effect at the time it was self-imposed, not because it represented a risk or hazard threshold for the project.

The report was, in sum, unequivocally favorable to maintaining the effects of Resolution N.° 2064-2019-SETENA and corroborated with the institution's own technical authority the arguments of the plaintiff. Its relevance to the decision-making process was, moreover, paramount, given that it had been specifically requested for that purpose.

Resolution N.° 0320-2020-SETENA maintained absolute silence regarding that report. It does not cite it, does not assess it, does not reproduce it, does not distinguish it, and does not reject it with any argument whatsoever. The Twelfth Recital of the challenged act acknowledges that a technical opinion was requested from the Departamento de Auditoría y Seguimiento Ambiental, but the text of the resolution then skips directly to other considerations without recording what resulted from that request. It is as though the report had never existed. The omission is total.

That omission vitiates the grounds in a serious and independent manner. Article 133 of the LGAP requires that the grounds exist as they were taken into account when issuing the act. When the Administration requests a technical opinion as input for its decision and then suppresses it from its reasoning without any explanation, the stated grounds do not correspond to the actual grounds: the evidence that contradicts the decision taken is concealed. The resolution should have assessed that report, accepted it if deemed correct, or rejected it with its own technical reasoning if deemed incorrect. Having done neither, the resolution was issued in complete disregard of a determinative element of judgment, which constitutes a defect in the grounds that gives rise to the absolute nullity of the act.

Furthermore, official communication MS-DPRSA-255-2020 of February 27, 2020, issued by the Ministerio de Salud merely six days after Resolution N.° 0320-2020-SETENA was issued, in response to official communication SETENA-SG-0328-2020 of February 26, 2020, by which SETENA itself had formally requested an opinion, independently confirmed—from the authority of the ministry responsible for the subject matter—exactly what Report SETENA-DT-ASA-1618-2019 had concluded: that the approved elevation for the cells of the sanitary landfill was 995 m.a.s.l. and that that elevation was part of the operational technical closure works validated by Resolution N.° 2064-2019-SETENA. The fact that that pronouncement postdated the challenged act precludes attributing it as a defect of omission of the 0320-2020; however, its content has evidentiary value as retroactive confirmation: it demonstrates that the technical opinion SETENA suppressed when issuing the act was not an isolated view but the institutional position of the Ministerio de Salud, corroborated at the moment it was formally consulted.

D. Defect in the content. Material impossibility of execution. The Por Tanto Segundo of Resolution N.° 0320-2020-SETENA instructed the Ministerio de Salud to establish the parameters for the technical closure of the PTA Uruka "with respect to the elevation of 985 m.a.s.l." and to indicate the new guidelines for the developer to submit the Operational Closure Action Plan.

Article 132, paragraph 1, of the LGAP provides that the content of an administrative act must be, among other conditions, possible. Content that imposes an obligation or establishes a framework for action whose execution is materially impossible violates that requirement and renders the act null and void.

The documentary evidence in the record—in particular Report SETENA-DT-ASA-1618-2019 and Report SETENA-DT-ASA-274-2020 of March 11, 2020, both issued by SETENA's own Departamento de Auditoría y Seguimiento Ambiental—establishes that at the time Resolution N.° 0320-2020-SETENA was issued, the PTA Uruka sanitary landfill was already operating at elevations above 985 m.a.s.l. The elevation of 985 m.a.s.l. was not a future parameter that could be reached; it was a threshold already physically surpassed. The Sixth Recital of Resolution N.° 0320-2020-SETENA itself acknowledged that that elevation had been self-imposed by the developer as an internal planning measure and had not been determined as a height requirement by SETENA or the Ministerio de Salud. Ordering that the technical closure be carried out with reference to an elevation already exceeded in fact is equivalent to ordering something that cannot be done without physically reversing the reality of the project. That material impossibility is not a matter of degree or difficulty but is absolute. The content of the challenged act was, from the moment of its issuance, impossible to execute, which vitiates it with absolute nullity pursuant to Article 132 of the LGAP.

E. Conclusion. The concurrence of the nullity defects in the challenged act—the error of law in the grounds based on SETENA's improper attribution of powers not belonging to the Tribunal Ambiental Administrativo and incorrect interpretation of its resolutions; the error of fact in the grounds based on the omission of Report SETENA-DT-ASA-1618-2019; and the defect in the content based on material impossibility of execution—results, pursuant to Articles 158 and 166 of the LGAP, in the absolute nullity of Resolution N.° 0320-2020-SETENA issued at 10:00 hours on February 21, 2020. These are not formal defects that could be ratified, nor deficiencies admitting procedural correction; they are serious defects that indefeasibly affect essential elements of the act.

The declaration of absolute nullity produces retroactive effects from the date of issuance of the act, pursuant to Article 171 of the LGAP. This means that Resolution N.° 0320-2020-SETENA must be treated as never having been issued, and that Resolution N.° 2064-2019-SETENA recovers its full legal force and effect from the date of its original issuance on June 28, 2019, together with all the subjective rights that arose from it in favor of the plaintiff.

The nullity declared also extends to the related acts challenged. In particular, Resolution N.° 0794-2020-SETENA, which rejected the petition for revocation filed by the plaintiff, is a related act whose existence and legal basis derive directly from the validity of Resolution N.° 0320-2020-SETENA; once the latter is declared null, the former loses its object and falls with it. For the reasons set forth, the complaint must be granted in its entirety, and it is so ordered.

NINTH. EXCEPTIONS OF LACK OF ACTIVE AND PASSIVE STANDING AND LACK OF RIGHT. The State raised in its statement of defense, jointly and without any independent argumentative development, the exception of lack of active and passive standing (legitimación activa y pasiva). The exception was stated in the prayer for relief without any section of either the statement of defense or the closing arguments setting forth the factual or legal reasons that, in the State's view, would support the absence of either of those two conditions in the parties to this litigation. That argumentative omission alone prevents the exception from succeeding; in any event, an analysis of the prerequisites for standing based on the record in this case leads to the same conclusion.

Active standing (legitimación activa). The plaintiff, Empresas Berthier EBI de Costa Rica S.A., holds environmental impact assessment file N.° FEAP-718-1998-SETENA and is the developer of the Parque de Tecnología Ambiental Uruka project. Resolution N.° 0320-2020-SETENA revoked to the plaintiff's detriment Resolution N.° 2064-2019-SETENA, the act that had recognized the Operational Closure Action Plan for the PTA Uruka and the operating elevation of 995 m.a.s.l. The company is therefore the direct and immediate addressee of the ablative effects of the challenged act: it holds a subjective right extinguished by that act, and its legal sphere was affected in a direct, personal, and certain manner. Pursuant to Article 10, paragraph 1, subparagraph a), of the Code of Administrative Litigation Procedure (Código Procesal Contencioso Administrativo, CPCA), active standing belongs to whoever invokes the holding of a subjective right or a legitimate interest affected by the challenged administrative conduct. Both conditions concur in the plaintiff without any room for debate.

Passive standing (legitimación pasiva). SETENA (Secretaría Técnica Nacional Ambiental) is a maximally deconcentrated organ (órgano desconcentrado en grado máximo) of MINAE, created by Article 83 of the Ley Orgánica del Ambiente N.° 7554, with exclusive jurisdiction and functional independence in the exercise of its powers. Lacking separate legal personality, SETENA's acts are attributed to the State as a public-law legal entity. Consequently, the defendant here is the appropriate passive party in these proceedings, pursuant to Article 12, paragraph 1, of the CPCA, which establishes that the defendant shall be the Administration that is the author of the impugnable conduct.

Accordingly, both the active standing of the plaintiff and the passive standing of the State are duly established in the record and conform without difficulty to the standards set by the legal order. The exception lacks factual and legal support and must be rejected. Likewise, for the reasons stated in the preceding Recital, the exception of lack of right is rejected, as it has been established that the plaintiff holds the right it invoked in its complaint.

TENTH. COURT COSTS: Pursuant to Article 193 of the CPCA, court costs (costas)—both procedural and attorneys' fees—constitute a charge imposed upon the losing party by virtue of being such. Exemption from this award is available only when the court finds sufficient cause to litigate or when the judgment is rendered by virtue of evidence whose existence was unknown to the opposing party. In this matter, the court finds that neither of those grounds for exemption applies, and accordingly the State, as the losing party, is ordered to pay the plaintiff's court costs in this action, together with interest accruing thereon from the date of their assessment until actual payment, as requested in the prayer for relief, to be quantified at the judgment-execution stage.

POR TANTO:

The exceptions of non-impugnable act, lack of current interest, lack of active and passive standing, and lack of right raised by the State are rejected. The complaint is granted in its entirety. The absolute nullity of Resolution No. 0320-2020-SETENA issued at 10:00 hours on February 21, 2020, adopted by the Plenary Commission of SETENA by means of Article No. 2 of Ordinary Session No. 017-2020 of February 25, 2020, is declared, as is the absolute nullity of Resolution No. 0794-2020-SETENA, issued at 09:45 hours on April 29, 2020, adopted by the Plenary Commission of SETENA at Ordinary Session No. 034-2020, Article No. 17, by reason of its connection to the foregoing. The State is ordered to pay all court costs of this action, together with interest accruing thereon from the date of their assessment until actual payment, to be quantified at the judgment-execution stage.

DEMANDADO/A:

EL ESTADO N° 2026003869 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las quince horas con dieciocho minutos del doce de junio del dos mil veintiseis.- Proceso de conocimiento contencioso administrativo incoado por Empresas Berthier EBI de Costa Rica S.A. cédula jurídica: 3-101-215741, representada por Patricia Campos Villagra, mayor, divorciada, abogada y notaria, vecina de San José, portadora de la cédula de identidad 1-880-762, en su condición de Gerente General con facultades de Apoderada Generalísima sin límite de suma; en contra de El Estado, que ha actuado bajo la dirección de la Procuradora Georgina Inés Chaves Olarte, carné de abogada número 4800. Como abogado director de la actora ha intervenido el Lic. Luis Lechtman Meltzer, carné profesional 10808.

CONSIDERANDO:

PRIMERO. ANTECEDENTES PROCESALES:

  1. 1Mediante libelo presentado el 30 de abril de 2020, Empresas Berthier EBI de Costa Rica S.A. interpuso proceso de conocimiento contencioso administrativo, en el que formuló las siguientes pretensiones: “Conforme a los hechos, fundamentos de derecho y prueba aportada a los autos, respetuosamente solicito que en sentencia: 1) Se decrete la disconformidad sustancial con el ordenamiento jurídico y consecuentemente la nulidad absoluta de la Resolución No. 0320-2020-SETENA dictada a las 10:00 horas del 21 de Febrero (sic) de 2020, adoptada por la Comisión Plenaria de SETENA mediante artículo No. 2 de la Sesión Ordinaria No. 017-2020 del 25 de Febrero (sic) de 2020. 2) Se declare también la nulidad absoluta de todos los actos conexos con la conducta formal aquí impugnada. 3) En caso de oposición a la presente demanda, se condene al Estado al pago de ambas costas de este Proceso (sic), junto con los respectivos intereses legales, que se computarán desde la cuantificación o determinación en firme de las mismas, hasta su efectivo pago.” (Imágenes 2 a 39 del expediente judicial).
  2. 2El 2 de julio de 2020, El Estado contestó negativamente la demanda, opuso las excepciones de falta de derecho, falta de legitimación activa y pasiva y falta de interés actual. Posteriormente, en etapa de conclusiones, alegó inadmisibilidad por acto no susceptible de impugnación. Solicitó que en sentencia se declare sin lugar la demanda en todos sus extremos, y se condene a la parte actora al pago de ambas costas, así como a los intereses sobre las costas. (Imágenes 225 a 246 del expediente judicial)
  3. 3El 15 de diciembre de 2020 se celebró audiencia preliminar, con la asistencia de todas las partes. No fue reclamada ninguna actividad procesal defectuosa. Se ratificaron las pretensiones en los mismos términos que fueron expresadas en el libelo de demanda. Se determinaron como controvertidos los hechos 5, 7, 9, 10, 11,12, 13, 14, 15, 19, 20 y 21 de la demanda. Fue admitida la prueba documental ofrecida, se declaró el asunto como de puro derecho, y se confirió audiencia para que las partes rindieran conclusiones por escrito. (Imágenes 318 a 321 del expediente judicial, así como la grabación de la audiencia incorporada a la carpeta electrónica).
  4. 4Ambas partes rindieron sus conclusiones dentro del plazo al efecto conferido. (Imágenes 324 a 366 del expediente judicial).
  5. 5Que, mediante acuerdo tomado por el Consejo Superior del Poder Judicial, en sesión N° 26-2025, celebrada el 27 de marzo de 2025, ARTÍCULO XXXII, se aprobó el plan de descongestionamiento para reducir el rezago judicial en asuntos de puro derecho del Tribunal Contencioso Administrativo y Civil de Hacienda, diseñado por la Dirección de Planificación, y contenido en el informe N° 310-PLA-MNP-2025, de 14 de marzo de 2025. Siendo que el presente expediente cumple con los criterios establecidos, fue incluido dentro del citado plan de descongestionamiento, y turnado a esta Sección para su fallo el 30 de mayo de 2024.   6. 6Se dicta la presente sentencia previa deliberación y por unanimidad de los integrantes del Tribunal, sin que se observen vicios u omisiones susceptibles de generar nulidad o indefensión a las partes. Redacta el juez Irías Obando con el voto afirmativo de la jueza Madriz Martínez y del juez Herrera Valverde.

SEGUNDO. HECHOS PROBADOS. En lo que resulta atinente por la forma en que se resuelve, la revisión de los alegatos y documentos aportados por las partes, permiten tener como acreditados los siguientes hechos:

  1. 1Que Empresas Berthier EBI de Costa Rica S.A., cédula jurídica 3-101-215741, opera el Relleno Sanitario denominado "Parque de Tecnología Ambiental Uruka" (en adelante PTA Uruka), ubicado en La Carpio, Uruca, San José, al amparo de la Viabilidad Ambiental otorgada por la Secretaría Técnica Nacional Ambiental (SETENA) mediante Resolución No. 652-2000-SETENA, dictada a las 12:00 horas del 18 de julio del año 2000. El proyecto se tramita bajo el expediente administrativo No. FEAP-718-1998-SETENA. Mediante Resolución No. 2628-2012-SETENA del 10 de octubre del 2012, la SETENA avaló la Actualización del Plan de Gestión Ambiental del proyecto, la cual contemplaba el cierre técnico y post-cierre técnico del relleno sanitario. (Expediente administrativo FEAP-718-1998-SETENA, Tomos I y siguientes; folios 4717 a 4831 del Tomo 24 y folio 7296 del Tomo 35 del expediente administrativo. Documentos visibles en las imágenes 42 a 151 del expediente electrónico.)
  2. 2Que la empresa Berthier EBI de Costa Rica S.A. fue objeto de denuncia ante el Tribunal Ambiental Administrativo en el expediente No. 215-07-02-TAA. Dicho proceso culminó con la Resolución No. 1364-18-TAA, dictada a las once horas quince minutos del 13 de diciembre de 2018, que en su parte dispositiva ordenó, entre otros extremos: "...XI. ORDENA al Dr. Daniel Salas Peraza en su condición de Ministro del Ministerio de Salud o quien ocupe su cargo, EN COORDINACIÓN CON LA SETENA, en la persona del señor Sergio Bermúdez Muñoz o quien ocupe su cargo, que procedan a mantener estricta vigilancia sobre la medición topográfica, para que una vez alcanzada la cota 985 msnm se giren las instrucciones técnicas para que se proceda con el proceso de cierre técnico, conforme a Derecho corresponde." Ante la solicitud de adición y aclaración presentada por la empresa, el Tribunal dictó la Resolución No. 461-19-TAA, mediante la cual rechazó dicha solicitud y ratificó lo resuelto en la Resolución No. 1364-18-TAA, precisando en su parte considerativa que la vida útil de un relleno sanitario puede variar en el tiempo según múltiples factores, y aclarando en su parte dispositiva que la cota de 985 msnm era el límite para el inicio del cierre técnico, siempre y cuando no existieran modificaciones avaladas mediante los procedimientos de ley y por las autoridades competentes.(Resoluciones No. 1364-18-TAA y No. 461-19-TAA del Tribunal Ambiental Administrativo, referidas en los Resultandos y Considerandos de la Resolución No. 0320-2020-SETENA, visible a folios 7589 a 7611 del Tomo 37 del expediente administrativo.)
  3. 3Que el 23 de febrero de 2019, la empresa Empresas Berthier EBI de Costa Rica S.A. dio cumplimiento a lo ordenado en la Resolución No. 1364-18-TAA, presentando ante el Tribunal Ambiental Administrativo los tres planes de mitigación que dicha resolución requería: a) Plan para la mitigación del ruido, sobre todo para jornada nocturna; b) Plan para el control de polvo y gases; y c) Plan para la contaminación causada por olores debido a los frentes de trabajo. Este cumplimiento fue expresamente reconocido en el Considerando Quinto de la Resolución No. 2064-2019-SETENA, que indicó: "...se confirma que la Empresa Berthier EBI de Costa Rica S.A. ha cumplido con lo determinado por el Tribunal Ambiental Administrativo en lo concerniente a la Resolución 1364-18-TAA del 13 de diciembre del 2018... Dichos Planes fueron presentados ante ese Tribunal en fecha 23 de febrero de 2019." (Ver Considerando Quinto de la Resolución No. 2064-2019-SETENA, folios 7432 a 7474 del Tomo 37 del expediente administrativo).
  4. 4Que el 31 de enero del 2019, la empresa Empresas Berthier EBI de Costa Rica S.A. presentó ante la SETENA la Propuesta de Cierre Técnico Operativo denominada "Plan de Acciones para el Cierre Operativo del PTA URUKA", complementada con un Estudio Técnico Geotécnico elaborado por la empresa INSUMA S.A. (Análisis de Estabilidad para la propuesta de Cierre Técnico a la cota 995 m.s.n.m.) y un juego de planos conceptuales. Dicho estudio geotécnico concluyó que en la condición actual y en la futura al llegar a la cota 995 msnm, el relleno sanitario es estable. (Ver folios 7268 a 7301, imágenes 175 a 208 del Tomo 35 del expediente administrativo.)
  5. 5Que el 1 de noviembre del 2019, el Ministerio de Salud emitió el informe de cumplimiento por la vía de la Plataforma APC del Colegio Federado de Ingenieros y Arquitectos al proyecto CFIA-884423 "Cierre Técnico Operativo PTA Uruca", aprobando el Plan de Acciones para el Cierre Operativo presentado por la empresa. El informe de cumplimiento tuvo en cuenta, entre otras consideraciones, que el estudio geotécnico de INSUMA S.A. concluía que el relleno es estable en la condición actual y futura al nivel 995 m.s.n.m., y que respetó el contenido de la Resolución No. 2064-2019-SETENA. (Ver Resolución No. 0872-2020-SETENA, folio 7764 del Tomo 38; oficio MS-DPRSA-360-2020, folios 7672 a 7680 del Tomo 38 del expediente administrativo.)
  6. 6Que mediante Resolución No. 2064-2019-SETENA, dictada a las catorce horas del 28 de junio de 2019, la Comisión Plenaria de la SETENA en Sesión Ordinaria No. 063-2019, Artículo No. 02, dispuso: "PRIMERO: Aprobar el "Plan de Acciones para el Cierre Operativo del PTA URUKA", el cual es complemento del proceso de gestión ambiental del proyecto. SEGUNDO: Con base a las proyecciones de la empresa desarrolladora, áreas de desarrollo disponibles (terrazas) y cotas de elevación propuestas 995 msnm y 969,6 msnm, se establece una Vida Útil restante de cuatro años para hacer efectivo el cierre operativo del proyecto e inicio de las actividades post cierre (vigilancia y control). Al menos un año antes de finalizar este período el desarrollador deberá actualizar los estudios técnicos que correspondan en cuanto niveles topográficos, estabilidad y capacidad volumétrica restante. TERCERO: Notificar esta resolución a la Dirección de Protección al Ambiente Humano del Ministerio de Salud para que, con base en sus competencias, considere las obras propuestas durante el proceso de cierre técnico operativo y actividades de post cierre e informe a esta Secretaría cualquier observación que corresponda.CUARTO: El desarrollador tiene el deber de seguir cumpliendo la normativa ambiental. QUINTO: Contra esta resolución cabe interponer dentro del plazo de tres días hábiles, contados a partir del día hábil siguiente a la notificación, los recursos ordinarios de revocatoria ante la SETENA, y el de apelación ante el Ministro de Ambiente, Energía y Telecomunicaciones de conformidad con los artículos 342 y siguientes de la Ley General de Administración Pública N° 6227 y 87 de la Ley Orgánica del Ambiente N° 7554." (Ver folios 7432 a 7474 del Tomo 37 del expediente administrativo, imágenes 107 a 121).
  7. 7Que el 4 de julio del 2019, la señora Melissa Flores Núñez, representante de la Asociación de Desarrollo de Residencial Ciudad Cariari (ASOCARIARI), interpuso Recurso de Revocatoria parcial con Apelación en Subsidio contra la Resolución No. 2064-2019-SETENA (consecutivo 5450 AJ). El 23 de julio del 2019, Empresas Berthier EBI de Costa Rica S.A. presentó escrito de oposición a dicho recurso. El 19 de febrero de 2020, la empresa presentó un segundo escrito de oposición. (Ver folios 7475 a 7478 y 7480 a 7490 del Tomo 37 del expediente administrativo.)
  8. 8Que mediante oficio SETENA-AJ-0712-2019 del 2 de diciembre de 2019, el Departamento Legal de la SETENA solicitó criterio técnico al Departamento de Auditoría y Seguimiento Ambiental para resolver el recurso de revocatoria interpuesto por la señora Melissa Flores Núñez. En respuesta, ese Departamento emitió el informe SETENA-DT-ASA-1690-2019 del 13 de diciembre del 2019, suscrito por el Ing. Alejandro González Barquero (Coordinador a.i.) y el M.Sc. Ing. Oscar Umaña Fernández (Especialista Ambiental), en el que se estableció: "PRIMERO: Debe de tenerse en cuenta que la Resolución del Tribunal Ambiental, que establecía una cota del Relleno de 985, se basó en una cota autoimpuesta por el Desarrollador, con base en la información técnico-científica del momento de las condiciones del Relleno. Es decir, este valor no lo emitió ninguna otra Instancia Gubernamental como resultado de algún estudio de capacidad soportante.SEGUNDO: El aumento de cota avalado por esta Secretaría para un nuevo valor de 995, surge como el resultado de los estudios técnicos realizados por la empresa INSUMA que utilizando programas de simulación y/o modelación determina que la altura del Relleno puede modificarse hasta la cota 995, con un adecuado factor de seguridad y sin poner en riesgo la estabilidad del relleno. Por lo que el aumento de altura y por ende de capacidad, responde al análisis científico realizado in situ y en concordancia con el Decreto de Rellenos Sanitarios del Ministerio de Salud. TERCERO: Que tal y como lo ha manifestado el Ministerio de Salud, la capacidad de recibo de un relleno sanitario, es variable y depende de muchos factores, y solo mediante estudios continuos en el tiempo se puede determinar la variación volumétrica de los residuos que permita calcular la capacidad de recibo de residuos en un relleno, bajo las condiciones adecuadas de seguridad.CUARTO: Por lo tanto, la cota indicada en la Resolución del Tribunal Ambiental de valor 985, fue mencionada por el desarrollador del proyecto en su momento, como una medida de planificación interna, para la cual se tenía información viable para ese momento y no porque se hubiera alcanzado un valor que representara riesgo o peligro para el proyecto y sus alrededores." (Ver informe SETENA-DT-ASA-1690-2019, imágenes 200 a 213 del expediente electrónico; folio 7492 del Tomo 37 del expediente administrativo.)
  9. 9Que mediante Resolución No. 0320-2020-SETENA, dictada a las 10:00 horas del 21 de febrero de 2020, adoptada por la Comisión Plenaria de la SETENA mediante Artículo No. 2 de la Sesión Ordinaria No. 017-2020 del 25 de febrero de 2020, se resolvió el Recurso de Revocatoria parcial con Apelación en Subsidio interpuesto por Melissa Flores Núñez contra la Resolución No. 2064-2019-SETENA. En su, Por Tanto, se dispuso: "PRIMERO: SE DECLARA CON LUGAR EL RECURSO y se revoca la resolución No. 2064-2019-SETENA en acato de las resoluciones del Tribunal Ambiental Administrativo. En relación a la solicitud de "Plan de Acciones para el Cierre Operativo del PTA URUKA", complementado con el Estudio Técnico Geotécnico y juego de planos conceptuales de la propuesta, se reserva para conocerlo a partir de que se cuente con la información técnica que se requiere en el Por Tanto Segundo. Lo anterior, en virtud de que no se consideró en el estudio la resolución del Tribunal Ambiental Administrativo que estableció una cota de 985 msnm y ordenó la coordinación con el Ministerio de Salud.De manera, que, de conformidad en el Considerando Segundo de esta resolución con base en la resolución del Tribunal, se determinan acciones para el análisis del Cierre Técnico. SEGUNDO: Se solicita al Ministerio de Salud: 1. Establecer, de conformidad con lo que le ordena el Tribunal Ambiental Administrativo, los parámetros sobre los cuales se debe ejecutar el cierre técnico de PTA URUKA con respecto a la cota 985 msnm. 2. Indicar los nuevos parámetros para que el desarrollador presente el "Plan de Acciones para el Cierre Operativo del PTA URUKA". 3. Que realice el levantamiento topográfico de la medición de cota, establecer la capacidad volumétrica actualizada y vida útil remanente. Todo lo anterior en el plazo de 10 días hábiles. Siendo que las acciones de cierre técnico le competen al Ministerio de Salud, se solicita mantener a esta Secretaría informada de todas las acciones correspondientes.TERCERO: Comunicar al desarrollador que una vez que se cuente con la información solicitada al Ministerio de Salud, en el Por Tanto Segundo, se le indicará los lineamientos bajo los cuales deberá llevar a cabo el cierre técnico. QUINTO: Contra esta resolución cabe interponer dentro del plazo de tres días hábiles, contados a partir del día hábil siguiente a la notificación, los recursos ordinarios de revocatoria ante la SETENA, y el de apelación ante el Ministro de Ambiente, Energía y Telecomunicaciones de conformidad con los artículos 342 y siguientes de la Ley General de Administración Pública N° 6227 y 87 de la Ley Orgánica del Ambiente N° 7554." (Ver folios 7589 a 7611, imágenes 276 a 298, del Tomo 37; también visible a folio 7705 del Tomo 38 del expediente administrativo.)
  10. 10Que mediante oficio No. MS-DPRSA-255-2020 del 27 de febrero del 2020, emitido por la Dirección de Protección Radiológica y Salud Ambiental del Ministerio de Salud en respuesta al oficio SETENA-SG-0328-2020, el Ministerio de Salud comunicó a la SETENA que: i) conforme al reporte operacional del cuarto trimestre de 2019, se estimaba un ingreso de 700 toneladas por día con una proyección de vida útil de aproximadamente entre 4 y 5 años; y ii) la cota máxima de elevación aprobada para las celdas del relleno sanitario es de 995 msnm, siendo dicha elevación parte de las obras de cierre técnico operativo conforme a la Resolución No. 2064-2019-SETENA. (Ver folios 7618 a 7630, imágenes 306 a 316, del Tomo 37 del expediente administrativo; aportado como Prueba 6 del expediente electrónico, imágenes 200 a 213.)
  11. 11Que el 9 de marzo de 2020, Empresas Berthier EBI de Costa Rica S.A., interpuso Recurso de Revocatoria con Apelación en Subsidio contra la Resolución No. 0320-2020-SETENA. Dicho recurso fue resuelto mediante Resolución No. 0794-2020-SETENA, dictada a las 09 horas 45 minutos del 29 de abril del 2020, adoptada por la Comisión Plenaria de la SETENA en Sesión Ordinaria No. 034-2020, Artículo No. 17, la cual dispuso: "PRIMERO: De conformidad con las razones de Hecho y Derecho del Considerando Segundo de esta resolución, se rechaza el Recurso de revocatoria contra la resolución No. 320-2020-SETENA por ser inadmisible, en virtud de que el acto que se impugna no es recurrible de conformidad con el artículo 345 de la LGAP, la fase recursiva precluyó con la emisión de la resolución No. 0320-2020 y se agotó la vía administrativa. SEGUNDO: En virtud de que se presentó el Recurso de apelación en subsidio, habiéndose declarado inadmisible el Recurso de Revocatoria, procede elevar la apelación en subsidio a conocimiento del Ministro de Ambiente y Energía." (Ver Resolución No. 0794-2020-SETENA, folio 7731 del Tomo 38 del expediente administrativo.)
  12. 12Que mediante oficio No. MS-DPRSA-360-2020 del 31 de marzo del 2020, emitido por la Dirección de Protección Radiológica y Salud Ambiental del Ministerio de Salud en respuesta a lo solicitado mediante la Resolución No. 0320-2020-SETENA, el Ministerio de Salud indicó que es el encargado de aprobar los proyectos de cierre de los rellenos sanitarios a través de la Plataforma APC del Colegio Federado de Ingenieros y Arquitectos, que ya había aprobado el Plan de Acciones para el Cierre Operativo del PTA Uruka el 1 de noviembre del 2019 incluyendo la cota transitoria de 995 msnm, y que: "(…) No se puede desatender el tema de disposición final de los residuos, ya que disposición final en sitios no autorizados se convierte en un problema de salud pública. Es por ello que el Ministerio de Salud, como rector en la materia, aprueba, como anteriormente se indicó, cómo se llevará a cabo el cierre técnico. Hasta tanto se dé el cierre técnico, el Ministerio de Salud procede bajo criterios técnicos de manera razonable y proporcionada a aprobar los proyectos, que perfectamente pueden aumentar la cota de forma transitoria para facilitar la operación de los rellenos sanitarios para posteriormente llegar al cierre técnico." (Ver folios 7672 a 7680, imágenes 11 a 29, del Tomo 38 del expediente administrativo.)
  13. 13Que mediante Resolución No. 0872-2020-SETENA, dictada a las 13:00 horas del 11 de mayo del 2020, la Comisión Plenaria de la SETENA en Sesión Extraordinaria No. 001-2020, Artículo No. 02, dispuso en su, Por Tanto: "PRIMERO: Se conoce el Informe del Ministerio de Salud, a que se refiere el oficio MS-DPRSA-360-2020 del 31 de marzo del 2020. SEGUNDO: En el procedimiento del cierre técnico del relleno sanitario PTA LA URUKA, SETENA se allana y sujeta a las atribuciones y competencias invocadas por el Ministerio de Salud en el referido informe, sin perjuicio de las facultades de vigilancia que son propias de la Secretaría. TERCERO: Dado lo anterior, se instruye al Departamento de Auditoría y Seguimiento Ambiental a seguir vigilante del cumplimiento de los Compromisos Ambientales del proyecto de referencia.". (Ver folio 7764 del Tomo 38 del expediente administrativo.)

TERCERO. HECHOS NO PROBADOS. No fueron aportados elementos de prueba suficientes que permitan acreditar los siguientes hechos constitutivos del derecho invocado por las partes.

1. Que la Resolución No. 0320-2020-SETENA haya sido expresa o tácitamente revocada, anulada, dejada sin efecto o sustituida por acto administrativo posterior alguno, incluyendo la Resolución No. 0872-2020-SETENA.

CUARTO. TEORÍA DEL CASO. SÍNTESIS DE LA DEMANDA. A continuación, se expresará una síntesis del contenido del libelo de demanda y de las conclusiones rendidas, dejando sentado que el Tribunal ha considerado con detalle todos los argumentos de las partes, y se referirá a ellos en los apartados correspondientes, de resultar procedente. En cuanto al cuadro fáctico, la representación actora relata que el 11 de diciembre de 1998 fue presentado ante la SETENA el Formulario de Evaluación Ambiental Preliminar del proyecto denominado Parque de Tecnología Ambiental, tramitado bajo expediente administrativo No. 718-1998-SETENA a nombre de su representada. El 17 de noviembre de 1999 se presentó el Estudio de Impacto Ambiental Exhaustivo del proyecto para su evaluación. El 3 de febrero del año 2000, mediante Resolución No. 093-2000-SETENA, se aprobó ese estudio, quedando la Declaratoria de Viabilidad Ambiental condicionada al cumplimiento de una serie de requisitos que se detallan en el acto, entre ellos la constitución de una garantía ambiental, el nombramiento de un responsable ambiental, la conformación de una Comisión de Monitoreo y la presentación de informes regenciales periódicos.

Mediante Resolución No. 652-2000-SETENA del 18 de julio del año 2000, se otorgó formalmente la Viabilidad Ambiental al proyecto. Se indica asimismo que el 30 de julio del 2012 se presentó ante la SETENA una Actualización del Plan de Gestión Ambiental del proyecto, la cual fue avalada mediante Resolución No. 2628-2012-SETENA de las 13:45 del 10 de octubre de 2012. Dicha actualización contemplaba el cierre técnico y el post-cierre técnico del proyecto. Conforme a esa propuesta aprobada, tal proceso requería de actividades operativas de clausura que se ejecutarían paralelamente a las actividades ordinarias de operación del relleno, con el propósito de ir desarrollando un cierre ordenado conforme avanzaran las operaciones normales. Refiere que la empresa fue denunciada ante el Tribunal Ambiental Administrativo, según el expediente No. 215-07-02-TAA, por supuestas infracciones ambientales, proceso que culminó con la Resolución No. 1364-18-TAA del 13 de diciembre de 2018.

En dicho acto, el Tribunal Ambiental dispuso, en lo que interesa, mantener estricta vigilancia sobre la medición topográfica, de modo que una vez alcanzada la cota 985 msnm se giraran las instrucciones técnicas para proceder con el proceso de cierre técnico conforme a derecho corresponde. Ante una solicitud de adición y aclaración formulada por EBI, el Tribunal Ambiental Administrativo emitió el Voto 461-19-TAA del 25 de marzo de 2019, en el que analizó la naturaleza variable de la vida útil de un relleno sanitario en función de múltiples factores técnicos y reiteró lo resuelto en cuanto a la cota de 985 msnm como umbral para iniciar el proceso de cierre técnico. El 31 de enero de 2019, mediante el consecutivo 0825-ASA, se presentó a SETENA la Propuesta de Cierre Técnico Operativo. El 9 de abril de 2019 se realizó una visita de inspección al proyecto por parte de un especialista ambiental del Departamento de Auditoría y Seguimiento Ambiental de la SETENA, quien constató que el proyecto se encontraba en operación normal, que no se observaban vectores como aves o ratas mezclándose con la basura, que la planta de tratamiento funcionaba correctamente sin emitir olores molestos, que los taludes se mostraban estables y que el sistema de desinfección y lavado de camiones operaba adecuadamente.

En ese mismo contexto se identificó que aguas residuales provenientes de casas colindantes eran vertidas hacia el relleno sin tratamiento. La representación actora expone que mediante Resolución No. 2064-2019-SETENA de las catorce horas del 28 de junio de 2019, emitida en la Sesión Ordinaria No. 063-2019, la Comisión Plenaria dispuso aprobar el Plan de Acciones para el Cierre Operativo del PTA Uruka como complemento del proceso de gestión ambiental del proyecto. Dicha resolución estableció, con base en las proyecciones de la empresa y en los estudios técnicos presentados, que la vida útil restante estimada era de cuatro años para hacer efectivo el cierre operativo, proyectando cotas de elevación de hasta 995 msnm y 969,6 msnm. Se indicó también que al menos un año antes de finalizar ese periodo el desarrollador debería actualizar los estudios técnicos correspondientes. El 4 de julio de 2019, la señora Melissa Flores Núñez, de la Asociación de Desarrollo de Residencial Ciudad Cariari (ASOCARIARI), interpuso un recurso de revocatoria parcial con apelación en subsidio contra esa resolución.

La empresa formuló escrito de oposición al recurso el 23 de julio de 2019 y nuevamente el 19 de febrero de 2020. Relata la actora que mediante la Resolución No. 0320-2020-SETENA, objeto de este proceso, la Comisión Plenaria dispuso revocar la Resolución No. 2064-2019-SETENA, en supuesto acato de las resoluciones del Tribunal Ambiental Administrativo. La parte actora denuncia que dicha resolución ignoró de manera absoluta el Informe SETENA-DT-ASA-1618-2019, emitido por el propio Departamento de Auditoría y Seguimiento Ambiental de la SETENA, el cual había sido solicitado para resolver el recurso de revocatoria y que concluía, en síntesis, que la cota de 985 msnm no fue fijada por ninguna instancia gubernamental como resultado de algún estudio de capacidad soportante sino que fue una medida de planificación interna de la empresa desarrolladora; que el aumento de cota avalado a 995 msnm surgía de estudios técnicos científicos que determinaron su viabilidad con adecuado factor de seguridad; y que la capacidad de recibo de un relleno sanitario es variable y depende de múltiples factores que solo pueden determinarse mediante estudios continuos.

Igualmente, la resolución impugnada ignoró el oficio MS-DPRSA-255-202027 del 27 de febrero de 2020, emitido por la Dirección de Protección al Ambiente Humano del Ministerio de Salud, el cual señalaba que la cota máxima de elevación aprobada para las celdas del relleno era de 995 msnm como parte de las obras de cierre técnico operativo, conforme a la Resolución No. 2064-2019-SETENA, y que la vida útil debe ser actualizada periódicamente por el administrador del relleno conforme al Reglamento sobre Rellenos Sanitarios. En los fundamentos de derecho, la representación actora desarrolla una serie de vicios que, a su juicio, afectan de nulidad absoluta la resolución impugnada. En primer término, alega un vicio en el motivo y el contenido del acto, argumentando que las resoluciones del Tribunal Ambiental Administrativo fueron cumplidas cabalmente por su mandante. Apoyándose en la definición del motivo del acto administrativo consagrada en el artículo 133 de la Ley General de la Administración Pública y en la doctrina del tratadista Ernesto Jinesta Lobo, sostiene que el motivo debe ser legítimo y existir tal como fue tomado en cuenta para dictar el acto.

En el caso concreto, afirma que el motivo es inexistente porque en ningún momento hubo incumplimiento de las órdenes del Tribunal Ambiental: EBI presentó oportunamente los tres planes requeridos por dicho Tribunal, a saber, el plan de mitigación del ruido nocturno, el plan para control de polvo y gases y el plan para la contaminación causada por olores en los frentes de trabajo. Ello fue reconocido en la propia Resolución No. 2064-2019-SETENA. La actora aclara que la empresa no pretendía aumentar la vida útil del proyecto de modo antijurídico, sino que sometió a consideración de las autoridades ambientales y de salud pública un plan de cierre técnico ordenado, que implica que el proyecto continúe operando durante la fase de clausura para generar los recursos económicos necesarios que permitan sufragar los elevados costos del cierre. Siendo inexistente el motivo, la nulidad se extiende indefectiblemente al contenido del acto, a tenor del artículo 132 de la Ley General de la Administración Pública.

Como segundo agravio, la representación actora desarrolla el tema del cierre técnico y el cumplimiento de lo ordenado por el Tribunal Ambiental Administrativo. Señala que la cota de 985 msnm nunca fue impuesta como requisito de altura por la SETENA ni por el Ministerio de Salud, sino que fue establecida por la propia empresa como un factor de planificación interna que indicara cuándo debía iniciarse la etapa de cierre operativo. Aclara que dicha cota fue tomada en cuenta en la resolución del Tribunal Ambiental con base en la información técnica disponible al momento, sin que ello significara que llegar a esa cota representara un riesgo para el proyecto o sus alrededores. La determinación de la vida útil del proyecto, sostiene la actora, le corresponde al desarrollador mediante estudios técnicos que estimen la disponibilidad de espacio útil, conforme lo reconoce el oficio DRS-UN-0624-2012 del Ministerio de Salud y lo ratifica el oficio MS-DPRSA-255-2020 del 27 de febrero de 2020.

El tercer agravio se refiere a la incompetencia del Tribunal Ambiental Administrativo para denegar, restringir o rechazar nuevos proyectos, adendas o ampliaciones de proyectos existentes. Con fundamento en el artículo 111 de la Ley Orgánica del Ambiente, la actora sostiene que las competencias de dicho Tribunal se circunscriben a recibir denuncias y constatar si existen infracciones ambientales, sin que le quepa ninguna injerencia sobre proyectos nuevos ni sobre ampliaciones de proyectos existentes. Interpreta que la resolución impugnada confundió la función de contralor de legalidad del Tribunal Ambiental Administrativo con una función de coadministración, lo cual es jurídicamente inadmisible, ya que dicho Tribunal no tiene facultades para valorar proyectos nuevos ni para interpretar sus propias resoluciones más allá de sus competencias, tarea que corresponde exclusivamente a los órganos técnicos del Ministerio de Salud y de la SETENA.

En este sentido, invoca la resolución No. 2010-5219 de la Sala Constitucional, en la que se reconoció que el cierre técnico de un relleno sanitario es un acto administrativo de las autoridades de salud que valoran las condiciones técnicas que lo motivaron, y que no corresponde a ningún otro órgano sustituir a las autoridades de salud para decretar dicho cierre si no se ha evidenciado técnicamente que esa sea la medida más aconsejable. Dado que la recurrente ASOCARIARI nunca aportó prueba técnica alguna que desvirtuara los estudios que sustentaban la Resolución No. 2064-2019-SETENA, al acogerse el recurso sin ese respaldo técnico, el vicio de la impugnación se trasladó al acto impugnado, tornándolo en nulo por vicio en el motivo y en el contenido. El cuarto agravio tiene por objeto el Informe SETENA-DT-ASA-1618-2019 del Departamento de Auditoría y Seguimiento Ambiental, cuya existencia fue absolutamente omitida por la resolución impugnada.

La actora denuncia que ese informe, elaborado por el propio cuerpo técnico de la SETENA a solicitud del Departamento Legal para resolver el recurso de revocatoria, concluyó de manera rotundamente favorable a mantener los efectos de la Resolución No. 2064-2019-SETENA. Sin embargo, la Comisión Plenaria no lo valoró ni siquiera admitió su existencia en ninguno de sus considerandos. La actora señala que esa omisión intencional de un elemento probatorio esencial evidencia la arbitrariedad del acto y determina que carezca de motivo y contenido, constituyendo en consecuencia una nulidad absoluta. El quinto agravio versa sobre la falta de valoración del oficio MS-DPRSA-255-202027 del 27 de febrero de 2020, emitido por el Ministerio de Salud. La representación actora explica que ese documento no solo fijó la posición oficial del órgano rector en materia de salud pública, sino que exhortó a la SETENA a ejercer correctamente sus competencias y a no autolimitarse de manera antijurídica en sus potestades por causa de una interpretación incorrecta de una resolución administrativa.

El Ministerio de Salud concluyó que resultaba no solo viable mantener el proyecto PTA Uruka en etapa de cierre técnico, sino que era absolutamente necesario para proteger el interés nacional representado por la salud y el ambiente. La actora señala que lo ordenado por la resolución impugnada en su, por tanto, concretamente, solicitar al Ministerio de Salud que establezca los parámetros para el cierre técnico con respecto a la cota 985 msnm y que realice un nuevo levantamiento topográfico, resultaba innecesario, incongruente y antijurídico, dado que ese Ministerio ya había emitido criterio expreso y favorable al Plan de Cierre Técnico aprobado. Al no haberse valorado ese informe, el motivo y el contenido del acto impugnado quedan viciados de nulidad absoluta. El sexto agravio apunta a que la resolución impugnada desconoció el Plan de Cierre Técnico y Post-Cierre aprobado mediante Resolución No. 2628-2012-SETENA.

La actora explica que ese plan ya contemplaba que durante la etapa de cierre técnico el proyecto debe continuar operando, pues los costos de ese proceso no pueden sufragarse si la empresa carece de ingresos. El acto de revocatoria, al ignorar ese antecedente, desconoció que el cierre técnico no puede realizarse si el proyecto no está en operación. El séptimo agravio apunta a que la resolución impugnada no valoró la realidad actual del proyecto al momento de emitirse, dado que para entonces la cota ya había superado los 985 msnm, situándose en 986,50 msnm conforme a la última medición del Ministerio de Salud. En ese contexto, el recurso de ASOCARIARI y la resolución que lo acogió carecían de interés actual, por lo que lo procedente habría sido el rechazo y archivo del recurso, de conformidad con el artículo 275 de la Ley General de la Administración Pública. Al no haberse actuado de esa manera, el motivo del acto resultó incongruente con la realidad, viciando también el contenido y el fin del acto.

El octavo agravio se refiere a que el proyecto de cierre técnico ya contaba con los visados del Ministerio de Salud y del Colegio Federado de Ingenieros y Arquitectos, lo cual evidenciaba que las autoridades competentes habían aprobado el proyecto, habiéndolo sometido a su valoración técnica y jurídica. La actora cita además la jurisprudencia de la Contraloría General de la República, que ha reconocido que la determinación de la vida útil de un relleno sanitario es una tarea que corresponde a los propios operadores de esos sitios, quienes son quienes conocen a fondo sus actividades, pues la vida útil es una actividad variante en el tiempo que no puede ser certificada por ninguna otra autoridad. En cuanto a las pretensiones de fondo, la representación actora solicita al Tribunal que en sentencia se decrete la disconformidad sustancial con el ordenamiento jurídico y la consecuente nulidad absoluta de la Resolución No. 0320-2020-SETENA; que se declare también la nulidad absoluta de todos los actos conexos con dicha conducta formal; y que en caso de oposición, se condene al Estado al pago de ambas costas del proceso junto con los respectivos intereses legales computados desde la determinación firme de su monto hasta su efectivo pago.

En sus conclusiones escritas, rendidas el 18 de diciembre de 2020 por el licenciado Luis Lechtman Meltzer en su condición de apoderado especial judicial de la actora, sostiene que la resolución impugnada genera una grave inseguridad jurídica para el desarrollo del cierre técnico del proyecto PTA Uruka, toda vez que su contenido, contrariamente a lo que argumenta el Estado, sí produce efectos jurídicos concretos y perniciosos que solo pueden ser anulados por el mismo ente que los creó o por un Tribunal competente. Afirma que la Procuraduría General de la República no está en posición de resolver ese conflicto y que únicamente este Tribunal puede declarar el alcance de los efectos de la resolución impugnada a través de sentencia. Rechaza la tesis del Estado según la cual la resolución impugnada no sería un acto susceptible de impugnación, calificándola de simplista e incorrecta. Explica que dicho acto revoca una licencia ambiental otorgada a su mandante y fija la capacidad máxima del proyecto a la cota de 985 msnm, lo que equivale a ordenar su cierre inmediato y definitivo, dado que esa cota ya había sido superada en buena parte del proyecto para la fecha de la resolución impugnada.

Se trata, en consecuencia, de un acto administrativo que genera un gravísimo perjuicio para la empresa y que es arbitrario e ilegal. Se argumenta además que la contestación de la demanda del Estado equivale prácticamente a un allanamiento tácito, pues éste reconoce que la determinación de la cota máxima del proyecto no es competencia de la SETENA sino del Ministerio de Salud. Si esa es la tesis del Estado, lo congruente habría sido allanarse formalmente a la demanda y proceder a la anulación de un acto que sostuvo lo contrario. La actora señala que la nueva Resolución No. 0872-2020-SETENA, en la que SETENA se allana a las competencias del Ministerio de Salud y avala el Informe MS-DPRSA-360-2020 del 31 de marzo de 2020, es prueba adicional de que la Secretaría reconoce el gravísimo error cometido al emitir la resolución impugnada. Ese nuevo informe del Ministerio de Salud ratificó todo lo que venía señalando su representada: que el aumento de cota estaba conforme con los estudios técnicos, que era necesario para el proceso de cierre técnico y que ese cierre se venía ejecutando de manera estable y exitosa desde hacía más de un año.

Señala que la pretendida justificación de la Resolución No. 0872-2020-SETENA, en el sentido de que la revocación de la resolución No. 2064-2019-SETENA era conteste con el ordenamiento jurídico porque ese órgano no tenía competencia para autorizar el alza de cotas, es falsa e incorrecta, dado que el propio Ministerio de Salud, en el Informe MS-DPRSA-360-2020, señala exactamente lo contrario: que la modificación de la cota fue tramitada y aprobada conforme a derecho. Concluye que si el Ministerio de Salud avaló esa modificación y SETENA ahora lo reconoce, no existe ninguna justificación jurídica para mantener firme la Resolución No. 0320-2020-SETENA, cuyas aseveraciones incorrectas y antijurídicas no pueden quedar firmes. Finalmente, la representación actora reitera que la viabilidad ambiental otorgada mediante la Resolución No. 2064-2019-SETENA era un requisito que el propio Ministerio de Salud exigía para visar los planos del proyecto de cierre técnico.

En consecuencia, dejar sin efecto esa viabilidad ambiental, sin que ello sea declarado judicialmente, genera un vacío jurídico que expone a la empresa ante numerosos adversarios del proyecto, quienes podrían aprovechar la existencia de resoluciones contradictorias en sede administrativa para impugnar el permiso otorgado por el Ministerio de Salud y para atacar a los representantes y profesionales responsables de la empresa. Afirma que en ese contexto de inseguridad jurídica, si el acto impugnado se mantiene firme, a su representada no le quedaría más opción que cerrar y abandonar el proyecto PTA Uruka, con las devastadoras consecuencias sanitarias y ambientales ya descritas. Por todas esas razones, solicita que el Tribunal declare la nulidad de los efectos de la Resolución No. 0320-2020-SETENA mediante sentencia.

QUINTO. SÍNTESIS DE LA OPOSICIÓN. Con la misma aclaración realizada con relación al libelo de demanda, en cuanto a que se presenta un resumen y síntesis de lo expresado por la parte, pero que todos los argumentos serán analizados en cuanto correspondan, se apunta lo alegado por la representación del Estado. En cuanto a los hechos de la demanda, la representación estatal acepta como ciertos los hechos primero al cuarto, correspondientes a la presentación del Formulario de Evaluación Ambiental Preliminar del proyecto, la presentación del Estudio de Impacto Ambiental, la aprobación de dicho estudio mediante Resolución No. 093-2000-SETENA y el otorgamiento formal de la Viabilidad Ambiental mediante Resolución No. 652-2000-SETENA. En cuanto al hecho quinto, acepta parcialmente que se presentó una actualización del Plan de Gestión Ambiental, pero rechaza por inexacta la fecha indicada de 30 de julio del 2012, precisando que la actualización se presentó el 27 de febrero del 2012.

Acepta como ciertos los hechos sexto al octavo, y respecto al hecho noveno lo acepta, pero señala que no es relevante para la resolución del asunto. Los hechos décimo y undécimo son aceptados parcialmente en cuanto a la existencia de las resoluciones del Tribunal Ambiental Administrativo, pero rechaza el resto por inexacto al considerar que las transcripciones realizadas por la actora son parciales y no reflejan la totalidad de lo resuelto; igualmente, advierte que esos hechos no son relevantes para resolver el asunto. El hecho duodécimo es rechazado por inexacto por las mismas razones, y la representación estatal aclara en particular que la resolución No. 1364-18-TAA del Tribunal Ambiental ordenó al Ministerio de Salud, en coordinación con la SETENA, mantener estricta vigilancia sobre la medición topográfica para que, una vez alcanzada la cota 985 msnm, se giraran las instrucciones técnicas para proceder con el proceso de cierre técnico.

Los hechos décimo tercero y décimo cuarto son aceptados parcialmente. El hecho décimo quinto, referente a la Resolución No. 2064-2019-SETENA, es rechazado por inexacto y la representación estatal aclara que su trascendencia es irrelevante para la resolución del asunto, en tanto la aprobación del Plan de Acciones para el Cierre Operativo del PTA Uruka es competencia exclusiva y excluyente del Ministerio de Salud, y no de la SETENA. El hecho décimo sexto es aceptado como cierto, con la aclaración de que el Plan de Acciones fue aprobado por el Ministerio de Salud el 1 de noviembre del 2019 y se encuentra plenamente vigente. Los hechos décimo sétimo y décimo octavo son aceptados. El hecho décimo noveno, relativo a la Resolución No. 0320-2020-SETENA, se acepta parcialmente en cuanto a la existencia de la resolución, rechazando el resto por inexacto, con la misma aclaración sobre la vigencia del Plan de Acciones.

El hecho vigésimo es rechazado por no constituir un hecho en sentido técnico jurídico sino una apreciación subjetiva. Finalmente, el hecho vigésimo primero es rechazado por inexacto, explicando que el oficio MS-DPRSA-255-2020 del 27 de febrero del 2020 fue emitido por el Ministerio de Salud en respuesta a una solicitud de la propia SETENA, y no en los términos en que lo presenta la actora. En los fundamentos jurídicos, la representación estatal desarrolla su posición a partir de los antecedentes del caso. Señala que la actora presentó a la SETENA el Plan de Acciones para el Cierre Operativo del PTA Uruka el 31 de enero del 2019, en el que indicó expresamente que el Plan de Gestión Ambiental no contemplaba nuevas medidas ambientales, pues la actividad no tendría ningún cambio significativo. A pesar de ello, y pese a que la aprobación de ese plan de cierre era competencia exclusiva del Ministerio de Salud, la SETENA emitió la Resolución No. 2064-2019-SETENA aprobando el plan y fijando una vida útil adicional de cuatro años.

Inconforme con ese acto, la señora Melissa Flores Núñez interpuso recurso de revocatoria con apelación en subsidio, y la SETENA, al resolver el recurso mediante la Resolución No. 0320-2020-SETENA, revocó la resolución No. 2064-2019-SETENA y solicitó al Ministerio de Salud la información técnica necesaria para proceder con el análisis del cierre técnico. El Ministerio de Salud respondió mediante el oficio MS-DPRSA-360-2020 del 31 de marzo del 2020, señalando que era el único órgano competente para otorgar la aprobación del plan de cierre y que ya lo había aprobado el 1 de noviembre del 2019 mediante el informe de cumplimiento del proyecto CFIA-884423, y que no podía indicar nuevos parámetros adicionales a los ya establecidos por la normativa. Ante esa respuesta, la SETENA emitió la Resolución No. 0872-2020-SETENA de las 13:00 horas del 11 de mayo del 2020, en la que determinó que no es el órgano competente para aprobar el plan de cierre técnico, dado que esa competencia recae únicamente en el Ministerio de Salud.

Como primera defensa de fondo, la representación estatal opone la excepción de falta de interés actual. Argumenta que la resolución No. 0320-2020-SETENA únicamente revocó la No. 2064-2019-SETENA y solicitó información al Ministerio de Salud para posteriormente conocer el plan de cierre; sin embargo, dado que el Ministerio de Salud indicó que el plan ya se encontraba aprobado bajo su competencia, se emitió la Resolución No. 0872-2020-SETENA en la que reconoció su incompetencia para pronunciarse en la materia. En consecuencia, el Plan de Acciones para el Cierre Operativo del PTA Uruka se mantiene plenamente vigente con la aprobación del Ministerio de Salud, lo que evidencia que no subsiste lesión alguna a los derechos de la actora. La representación estatal invoca jurisprudencia de la Sala Primera de la Corte Suprema de Justicia en la que se ha establecido que la falta de interés actual equivale a ausencia de fundamento en la pretensión anulatoria, al no existir perjuicio actual o pendiente susceptible de reparación.

Concluye que los eventuales daños o riesgos que invoca la actora son remotos e hipotéticos y no constituyen fundamento para accionar en la vía contenciosa. Como segundo argumento de fondo, la representación estatal rechaza la afirmación de la actora en el sentido de que la Resolución No. 0320-2020-SETENA habría revocado una licencia o viabilidad ambiental. Señala que esa afirmación es incorrecta, pues la viabilidad ambiental del proyecto fue otorgada mediante la Resolución No. 652-2000-SETENA de las 12:00 horas del 18 de julio del 2000, la cual no fue revocada. La Resolución No. 2064-2019-SETENA no constituía una viabilidad ambiental, sino que versaba sobre la solicitud de aprobación del Plan de Acciones de Cierre, lo cual, se insiste, es competencia del Ministerio de Salud y no de la SETENA. La representación estatal indica que las diferentes etapas de la ejecución de un relleno sanitario, apertura, desarrollo y cierre, son valoradas desde el momento en que se otorga la viabilidad ambiental, la cual es requisito previo para el permiso sanitario de funcionamiento.

El cierre técnico no es más que una de esas etapas y su aprobación le corresponde al Ministerio de Salud como autoridad competente en materia de control y habilitación de rellenos sanitarios. Para sustentar esta tesis, la representación estatal invoca el artículo 7 de la Ley para la Gestión Integral de Residuos, No. 8839, que establece al jerarca del Ministerio de Salud como rector en la materia, con potestades de dirección, monitoreo, evaluación y control; y los artículos 8 al 13 del Decreto Ejecutivo No. 38928-S, Reglamento sobre Rellenos Sanitarios, de los cuales se deriva que toda la tramitación ante el Ministerio de Salud, permiso de ubicación, revisión de planos constructivos y permiso sanitario de funcionamiento, es competencia de dicha institución. Enfatiza además que ninguna norma del ordenamiento jurídico establece que el cierre técnico de un relleno sanitario requiera de una viabilidad ambiental adicional otorgada por la SETENA, como lo interpreta erróneamente la actora.

Concluye que la Resolución No. 0872-2020-SETENA, al corregir el error en que incurrió la SETENA al pronunciarse sobre un asunto que escapaba a su competencia, es conforme a derecho y no afecta los derechos subjetivos de la demandante, en tanto la aprobación del Plan de Cierre ya fue otorgada por la autoridad competente desde el 1 de noviembre del 2019. En sus conclusiones escritas, la representación estatal desarrolla con mayor detalle su posición bajo dos grandes ejes argumentativos: la inadmisibilidad de la demanda y la improcedencia del fondo. En cuanto a la inadmisibilidad, reitera que la resolución No. 0320-2020-SETENA es, en rigor, un acto de mero trámite cuyo efecto consistió exclusivamente en revocar la Resolución No. 2064-2019-SETENA y solicitar información al Ministerio de Salud para poder resolver ulteriormente sobre el plan de cierre técnico. Sostiene que ese acto no tiene efecto propio ni genera una situación jurídica definitiva, por lo que su eventual anulación únicamente hubiera podido perseguirse en conjunto con la resolución final No. 0872-2020-SETENA, en la que la SETENA se declaró definitivamente incompetente en la materia.

Sin embargo, la actora no impugnó esta última resolución, lo cual constituye una decisión propia de la demandante que no puede ser suplida por el Tribunal. Cita jurisprudencia del Tribunal Contencioso Administrativo en la que se ha establecido que un acto de trámite no puede ser impugnado de manera autónoma en la vía contenciosa, sino únicamente cuando ocasiona indefensión o resuelve el fondo del asunto, circunstancias que no concurren en el presente caso. Sobre el fondo, la representación estatal insiste en que no existe lesión actual a los derechos de la actora. Invoca el contenido del oficio MS-DPRSA-360-2020 del 31 de marzo del 2020 del Ministerio de Salud, aportado por el propio Estado en este proceso, que confirmó que el plan de cierre técnico del PTA Uruka ya se encontraba aprobado bajo su competencia desde el 1 de noviembre del 2019. Agrega que la Resolución No. 0872-2020-SETENA, al reconocer la incompetencia de la SETENA para valorar la elevación de la cota de disposición de desechos y para aprobar el cierre técnico, no hace otra cosa que corregir el error de la Resolución No. 2064-2019-SETENA, que se había pronunciado sobre un asunto que escapaba a sus competencias legales.

Destaca que la actora misma no impugnó la Resolución No. 0872-2020-SETENA, lo que demuestra que reconoció que ese acto sí era conforme a derecho y no afectaba sus derechos. En ese sentido, la subsistencia del Plan de Acciones aprobado por el Ministerio de Salud hace que los daños hipotéticos invocados por la actora: cierre forzoso, colapso sanitario, afectación a quince municipalidades, sean conjeturales y carezcan del grado de actualidad que exige la jurisprudencia para sustentar una acción contencioso-administrativa. Finalmente, en relación con la tesis de la actora de que la viabilidad ambiental otorgada mediante la Resolución No. 2064-2019-SETENA era un requisito que el Ministerio de Salud exigía para visar los planos del proyecto de cierre técnico, la representación estatal señala que ello es un error de la actora. El artículo 10, inciso e), del Decreto Ejecutivo No. 38928-S exige una viabilidad ambiental como requisito para el permiso de ubicación, y el proyecto ya cuenta con ella desde el año 2000.

Ninguna disposición normativa impone la obligatoriedad de obtener una viabilidad ambiental adicional para proceder con la etapa de cierre técnico, por lo que la tesis de la actora carece de sustento legal. Solicita en consecuencia que se declare inadmisible la demanda, y subsidiariamente que se declare con lugar la excepción de falta de interés actual, falta de derecho y falta de legitimación, con la consecuente condenatoria en costas a la parte actora.

SEXTO. DEFENSA DE ACTO NO SUSCEPTIBLE DE IMPUGNACIÓN. Antes de ingresar al análisis de fondo, es necesario precisar la razón por la cual esta defensa se examina en primer lugar y con preferencia sobre cualquier otra cuestión litigiosa. La defensa de acto no susceptible de impugnación ostenta carácter procesal impeditivo: si prosperara, el Tribunal quedaría imposibilitado de pronunciarse sobre el mérito del asunto, lo que desembocaría en una sentencia de naturaleza inhibitoria que declararía la inadmisibilidad de la demanda, sin posibilidad de adentrarse en los vicios de nulidad invocados por la parte actora. Ese carácter impeditivo determina su conocimiento prioritario y exige, igualmente, que se le examine a plenitud. A. Posición de las partes. La representación del Estado invoca la inadmisibilidad del proceso con fundamento en que la conducta formal impugnada, la Resolución N.° 0320-2020-SETENA de las 10:00 horas del 21 de febrero de 2020, constituye un acto de mero trámite que no causa estado ni produce un efecto propio definitivo en el ordenamiento jurídico.

Sustenta su postura en que el acto cuestionado se limitó a resolver un recurso de revocatoria planteado por un tercero, disponiendo revocar la Resolución N.° 2064-2019-SETENA y reservar el conocimiento del plan de cierre hasta que el Ministerio de Salud emitiera los parámetros técnicos correspondientes. Según la tesis del Estado, el acto final del procedimiento es la posterior Resolución N.° 0872-2020-SETENA, en la cual la Secretaría Técnica Nacional Ambiental (SETENA) se allanó a las potestades del Ministerio de Salud, por lo que la demanda incumple los presupuestos del artículo 36, inciso c), del Código Procesal Contencioso Administrativo (CPCA). Por su parte, la empresa actora objeta de manera categórica esa calificación jurídica. Argumenta que la Resolución N.° 0320-2020-SETENA no puede encuadrarse como un acto de mero trámite, en tanto: revocó directamente un acto favorable que reconocía condiciones de viabilidad para el cierre técnico; fijó un límite operativo que para la fecha de emisión del acto ya había sido superado en la práctica, equivaliendo ello a una orden implícita de cese inmediato; y que, pese a la emisión de la Resolución N.° 0872-2020-SETENA, la revocación operada nunca fue formalmente dejada sin efecto.

Aduce, en suma, que el acto impugnado le causó un gravísimo perjuicio sustancial de manera directa e independiente, lo que lo dota de efectos propios plenamente susceptibles de control jurisdiccional. B. Criterio del Tribunal. El parámetro de control para resolver esta defensa se encuentra en el artículo 36, inciso c), del Código Procesal Contencioso Administrativo (Ley N.° 8508), norma que establece con claridad que la pretensión administrativa será admisible contra los actos administrativos "ya sean finales, definitivos o de trámite con efecto propio". La doctrina nacional y la jurisprudencia reiterada de la Sala Primera de la Corte Suprema de Justicia han precisado que el denominado acto de trámite con efecto propio, o acto de trámite cualificado, es aquel que, si bien se dicta de manera intermedia dentro de las secuencias de un procedimiento formal, incide de forma directa, sustancial e irreversible en la esfera jurídica del administrado: predetermina el sentido del fallo final, extingue derechos legítimos, genera indefensión insalvable o le impone un gravamen que no puede ser enmendado siquiera con el dictado del acto de clausura.

La ratio de esa categoría normativa radica en evitar que, bajo el blindaje conceptual del "trámite", la Administración despliegue conductas formales capaces de consumar perjuicios irreparables sin que el administrado pueda acudir oportunamente a la tutela jurisdiccional. Con ese parámetro en mente, corresponde ahora analizar si la Resolución N.° 0320-2020-SETENA constituye un acto de mero trámite sin efecto propio, como sostiene el Estado, o si, por el contrario, reúne las características de un acto de trámite cualificado con efectos propios e independientes. El Tribunal concluye, con fundamento en cinco razones que se exponen a continuación, que la defensa opuesta carece de asidero legal y debe ser rechazada. i. La Resolución N.° 0320-2020-SETENA produjo un efecto ablatorio autónomo e inmediato: la revocación del acto favorable preexistente. La empresa actora contaba, al momento de dictarse el acto impugnado, con un derecho formalizado mediante la Resolución N.° 2064-2019-SETENA de las catorce horas del 28 de junio de 2019.

Ese acto aprobó el "Plan de Acciones para el Cierre Operativo del PTA URUKA" y, sobre la base de estudios técnicos de estabilidad de taludes elaborados por la firma INSUMA S.A., reconoció una cota de elevación de hasta 995 m.s.n.m. como condición técnicamente viable para ejecutar el cierre técnico ordenado durante un período de cuatro años. En su Por Tanto Primero, la Resolución N.° 0320-2020-SETENA dispuso revocar en su totalidad ese acto aprobatorio. Esa revocación constituyó un efecto ablatorio completo, autónomo e inmediato: en el preciso instante en que el acto impugnado fue notificado, la Resolución N.° 2064-2019-SETENA dejó de existir jurídicamente y la empresa quedó desprovista de la cobertura bajo la cual ejecutaba el proceso de cierre técnico. No se trató de un paso neutral dentro de un procedimiento: se suprimió de raíz un acto que reconocía derechos subjetivos y establecía condiciones específicas de operación para una actividad de alto impacto e interés público.

La revocación no estuvo condicionada a la obtención de información ulterior ni subordinada al dictado de ningún acto posterior; fue definitiva e inmediata desde su adopción. Esa extinción del amparo jurídico previo constituye, por sí sola, un efecto propio de primer orden. ii. El mandato implícito de sujeción a la cota 985 m.s.n.m. equivalía, en términos operativos, a una orden de cese inmediato de las operaciones. El Por Tanto Segundo de la Resolución N.° 0320-2020-SETENA ordenó al Ministerio de Salud establecer los parámetros del cierre técnico "con respecto a la cota 985 msnm", indicar los nuevos lineamientos para el Plan de Cierre y realizar el levantamiento topográfico de la cota máxima del relleno. Esa disposición, considerada en conjunto con el contexto técnico acreditado en autos, produjo un efecto propio. Según consta de la prueba documental incorporada al expediente, en particular del Informe SETENA-DT-ASA-1618-2019 del Departamento de Auditoría y Seguimiento Ambiental de la propia SETENA, para la fecha de emisión del acto impugnado el relleno sanitario PTA Uruka ya operaba en cotas superiores a los 985 m.s.n.m.

Esa cota había sido fijada originalmente en las resoluciones del Tribunal Ambiental Administrativo con base en una limitación autoimpuesta por la propia empresa en el momento en que disponía de menor información técnica; no fue producto de estudios de capacidad soportante de ninguna autoridad pública. Los estudios posteriores de INSUMA S.A. demostraron que el relleno podía alcanzar con seguridad los 995 m.s.n.m., lo cual fue avalado por el Ministerio de Salud a través de la plataforma APC del Colegio Federado de Ingenieros y Arquitectos desde el 1 de noviembre de 2019. Obligar a la empresa a sujetarse, de forma inmediata, a un límite topográfico ya físicamente superado equivalía en la práctica a ordenarle el cese forzoso, inmediato y definitivo de la recepción de desechos sólidos, sin el soporte logístico de las terrazas superiores técnicamente avaladas. Ese efecto de paralización operativa real, concreto e independiente, es un efecto propio del acto impugnado que se actualizó con su sola notificación, con independencia de cualquier pronunciamiento ulterior. iii.

El Por Tanto Segundo condicionó la actuación futura del Ministerio de Salud dentro de un marco predeterminado, produciendo efectos propios sobre un órgano con competencia independiente. Un tercer efecto propio se advierte cuando se examina el alcance real del Por Tanto Segundo de la Resolución N.° 0320-2020-SETENA: la instrucción al Ministerio de Salud de establecer los parámetros del cierre técnico "con respecto a la cota 985 msnm" no fue una consulta abierta ni una remisión en blanco a las competencias de ese Ministerio. Fue una instrucción que vinculaba anticipadamente la actuación de un órgano con competencia propia e independiente a una premisa jurídica que no le fue puesta a discusión: la intangibilidad de la cota de 985 m.s.n.m. como límite infranqueable. Un acto de mero trámite no puede, por definición, condicionar ni predeterminar la actuación futura de otro órgano dotado de competencias exclusivas.

Lo que hizo la SETENA mediante el Por Tanto Segundo fue exactamente eso: establecer un marco jurídico previo y obligatorio dentro del cual el Ministerio de Salud quedaba compelido a ejercer sus propias atribuciones. Ese efecto sobre la esfera de actuación de un tercero institucional, más allá de la esfera de la empresa actora, confirma que el acto impugnado trasciende con creces la naturaleza del simple trámite procedimental. iv. La Resolución N.° 0872-2020-SETENA no constituye el "acto final del procedimiento" en el sentido normativo del artículo 36, inciso c), del CPCA. El Estado sostiene que el acto final del procedimiento fue la Resolución N.° 0872-2020-SETENA, y que era ese el acto que debió impugnarse. El argumento no resiste el cotejo con el texto de esa resolución. Su Por Tanto Primero simplemente hace constar que se tomó conocimiento del informe del Ministerio de Salud (oficio MS-DPRSA-360-2020 del 31 de marzo de 2020).

Su Por Tanto Segundo dispone que la SETENA "se allana y sujeta a las atribuciones y competencias invocadas por el Ministerio de Salud en el referido informe, sin perjuicio de las facultades de vigilancia que son propias de la Secretaría". Esa resolución no resolvió la solicitud de aprobación del Plan de Cierre presentada por la empresa actora. No aprobó ni rechazó dicho plan. Simplemente declaró que la competencia para aprobarlo correspondía al Ministerio de Salud, competencia que, dicho sea de paso, el Ministerio ya había ejercido el 1 de noviembre de 2019, y se abstuvo de pronunciarse sobre el fondo por falta de competencia. Un acto que declara incompetencia y se inhibe de resolver el asunto de fondo no es el "acto final" de un procedimiento en el sentido técnico del artículo 36, inciso c), del CPCA. El acto final es aquel que decide el fondo del asunto que estuvo en discusión. La Resolución N.° 0872-2020-SETENA no lo hizo.

La Resolución N.° 0320-2020-SETENA, en cambio, sí decidió: revocó derechos y fijó un límite operativo de consecuencias inmediatas. Fue esa, y no la ulterior, la resolución que ostentó el carácter de acto decisorio autónomo susceptible de control jurisdiccional. Se agrega que la Resolución N.° 0872-2020-SETENA no anuló ni dejó sin efecto la Resolución N.° 0320-2020-SETENA. La revocación operada por esta última permaneció como declaración jurídica formal vigente. La inseguridad jurídica que de ello se derivó para la empresa actora ya había producido efectos reales e irreversibles antes de que la Resolución N.° 0872-2020-SETENA fuera siquiera dictada. v. La propia SETENA habilitó recursos ordinarios contra la Resolución N.° 0320-2020-SETENA. El argumento más contundente contra la tesis del Estado proviene del texto mismo del acto que el Estado pretende inmune al control jurisdiccional. El Por Tanto Octavo de la Resolución N.° 0320-2020-SETENA estableció, textualmente: "Contra esta Resolución cabe interponer dentro del plazo de tres días hábiles, contados a partir del día siguiente a la notificación, los recursos ordinarios de revocatoria ante la SETENA, y el de apelación ante el Ministro de Ambiente y Energía, de conformidad con los artículos 342 y siguientes de la Ley General de Administración Pública y 87 de la Ley Orgánica del Ambiente." Esa disposición es de una trascendencia jurídica que no puede ignorarse.

Los actos de mero trámite no son susceptibles de impugnación autónoma precisamente porque carecen de efectos propios. El artículo 345 de la Ley General de la Administración Pública reserva los recursos ordinarios para el acto que inicia el procedimiento, el que deniega prueba y el acto final. Al habilitar expresamente esos recursos contra la Resolución N.° 0320-2020-SETENA, con el plazo de tres días que el ordenamiento reserva para los actos finales, la propia SETENA reconoció en ese momento que dicha resolución producía efectos propios y era susceptible de causar perjuicio directo al administrado. Cabe anticipar que la empresa actora efectivamente interpuso recurso de revocatoria contra la Resolución N.° 0320-2020-SETENA, y que este fue declarado inadmisible mediante la Resolución N.° 0794-2020-SETENA. Podría sostenerse que esa declaratoria de inadmisibilidad contradice el reconocimiento de recursividad contenido en el Por Tanto Octavo.

Sin embargo, el examen de la Resolución N.° 0794-2020-SETENA revela que el rechazo del recurso de la actora no se fundó en que el acto careciera de efectos propios, sino en una razón técnico-procedimental completamente distinta: que la resolución que decide un recurso de revocatoria es, a su vez, irrecurrible mediante una nueva revocatoria, conforme al artículo 345 de la Ley General de la Administración Pública, por haberse agotado la fase recursiva con la emisión de la Resolución N.° 0320-2020. Irrecurribilidad en sede administrativa por agotamiento de la vía recursiva es una categoría jurídica radicalmente diferente a la de ausencia de efectos propios. La primera cierra la vía administrativa; la segunda cierra también la judicial. La SETENA operó la primera; el Estado pretende ante este Tribunal la segunda. Esta distinción es decisiva. Precisamente porque la vía administrativa quedó agotada con la emisión de la Resolución N.° 0320-2020-SETENA, la empresa actora se encontraba habilitada para acudir a la sede contencioso-administrativa, que es lo que hizo mediante la presente demanda.

El rechazo del recurso por la 0794-2020 no enerva, sino que confirma, que la Resolución N.° 0320-2020-SETENA era el acto con efectos propios que puso fin a la vía administrativa y abrió la puerta a la tutela judicial. La SETENA habilitó recursos ordinarios contra ese acto reconociendo su capacidad de producir efectos propios; luego, al rechazar el recurso de la actora, constató que esos efectos propios ya habían agotado la vía administrativa; y el Estado pretende ahora, ante este Tribunal, que ese mismo acto carecía de efectos propios. Esa triple contradicción no puede prosperar, y este Tribunal no la avala. C. Conclusión: Examinadas las cinco razones precedentes, este Tribunal concluye, sin margen de duda, que la Resolución N.° 0320-2020-SETENA no constituye un acto de mero trámite sin efecto propio. Por el contrario, reúne de manera acumulada los atributos del acto de trámite cualificado con efectos propios e independientes: produjo una revocación ablativa inmediata de derechos subjetivos preexistentes; impuso de facto una orden de paralización operativa; condicionó la actuación de otro órgano con competencia propia; fue el único acto con efecto decisorio real en la secuencia procedimental; y fue calificada como acto final recurrible por la propia Administración emisora. La defensa de inadmisibilidad opuesta por el Estado carece, en consecuencia, de asidero legal y debe ser rechazada, como en efecto se hace.

SÉTIMO. EXCEPCIÓN DE FALTA DE INTERÉS ACTUAL. La excepción de falta de interés actual opuesta por el Estado comparte con la defensa resuelta en el considerando precedente su naturaleza procesal impeditiva: de prosperar, impediría al Tribunal pronunciarse sobre el mérito del asunto y daría lugar a una sentencia de carácter inhibitorio. Sin embargo, presenta una particularidad técnica que la distingue de aquella: la presencia del interés actual no es únicamente un requisito de admisibilidad que deba satisfacerse al momento de presentar la demanda, sino un presupuesto que debe mantenerse durante todo el desarrollo del proceso y que el juzgador está habilitado, y obligado, a examinar de oficio en cualquier estadio procesal, incluso al momento de dictar sentencia. Así lo ha establecido de manera reiterada la Sala Primera de la Corte Suprema de Justicia, y así lo confirma la propia jurisprudencia que el Estado invoca en su favor.

El Tribunal aborda esta excepción en este momento por razones de economía procesal y por la lógica del iter argumentativo. A. Tesis del Estado. La representación del Estado estructura su excepción sobre tres premisas encadenadas. La primera es de orden jurisprudencial: invocando la sentencia N.° 708-F-S1-2016 de las 8:30 horas del 30 de junio de 2016 de la Sala Primera de la Corte Suprema de Justicia, afirma que el interés actual exige que la anulación del acto impugnado le reporte un beneficio directo, real y concreto al demandante; que ese beneficio no se verifica si la falta de sentencia no le produce daño o perjuicio alguno; y que no es tutelable el denominado interés simple en la mera legalidad abstracta de la actuación administrativa. La segunda premisa es fáctica: el Plan de Acciones para el Cierre Operativo del PTA Uruka ya fue aprobado por el Ministerio de Salud, órgano que, según el Estado, es la única autoridad competente en la materia, mediante informe de cumplimiento emitido el 1 de noviembre de 2019 por la plataforma APC del Colegio Federado de Ingenieros y Arquitectos (proyecto CFIA-884423 "Cierre Técnico Operativo PTA Uruca"), con anterioridad incluso a la emisión de la Resolución N.° 0320-2020-SETENA.

La tercera premisa es de consecuencia jurídica: la Resolución N.° 0872-2020-SETENA reconoció esa competencia del Ministerio de Salud y se allanó a ella expresamente. Siendo así, la empresa actora ya cuenta con la aprobación de la única autoridad competente para avalar su plan de cierre técnico, de manera que ningún daño ni perjuicio subsiste en su esfera jurídica que pueda ser removido por una sentencia anulatoria de la Resolución N.° 0320-2020-SETENA. La actora carece, en consecuencia, de interés actual y la demanda debe declararse improcedente. B. Criterio del Tribunal. Esta Cámara acoge el marco jurisprudencial citado por el Estado como parámetro correcto para resolver esta excepción, pues esa misma jurisprudencia, correctamente aplicada, conduce a la conclusión opuesta a la que el Estado pretende. La Sala Primera, en las sentencias invocadas, entre ellas la N.° 708-F-S1-2016, N.° 1023-F-S1-2009, N.° 900-F-S1-2011 y N.° 528-F-S1-2011, ha definido el interés actual como la necesidad de tutela en que se encuentra una persona en concreto, determinada por la insatisfacción de un interés legítimo o un derecho subjetivo, que la motiva a solicitar la intervención jurisdiccional.

Para que ese interés sea tutelable debe reunir cuatro características: que la anulación del acto produzca un beneficio directo para el demandante mediante la eliminación de un acto perjudicial; que la repercusión de esa anulación sea directa e inmediata sobre su situación jurídica; que sea personal y concreto en el impugnante; y que sea actual y cierto, existente al momento de la demanda y durante todo el proceso, ya sea porque se ha producido un daño o porque este es previsible conforme a las circunstancias normales del caso. El criterio central que la Sala Primera establece para el juicio de utilidad es el siguiente: si la falta de sentencia le produce daño o perjuicio a quien solicitó tutela, hay interés; si no lo ocasiona, no lo hay. Aplicado este parámetro al presente caso, la conclusión es inequívoca: la empresa actora sí sufre un perjuicio actual y concreto por la vigencia de la Resolución N.° 0320-2020-SETENA, y la declaración judicial de su nulidad sí le produciría un beneficio directo e inmediato.

Las razones que sustentan esa conclusión se exponen a continuación. i. El derecho subjetivo extinguido por la Resolución N.° 0320-2020-SETENA no fue restablecido por ningún acto posterior, y su restauración constituye el objeto propio de la pretensión anulatoria. La Resolución N.° 2064-2019-SETENA otorgó a la empresa actora un derecho subjetivo de contenido complejo y específico: aprobó en su integridad el Plan de Acciones para el Cierre Operativo del PTA Uruka, incluyendo los planos constructivos CFIA-884423; validó técnicamente la cota de 995 m.s.n.m. como parámetro operativo viable para el cierre; y determinó una vida útil restante de cuatro años para hacer efectivo dicho cierre. Ese conjunto de reconocimientos no constituyó una mera expectativa ni una autorización provisional, sino que fue un acto aprobatorio formal, dictado por el órgano con competencia en materia de gestión ambiental, con fundamento en estudios técnicos de estabilidad de taludes elaborados por la firma INSUMA S.A. y en una inspección de campo, dentro del expediente administrativo de Evaluación de Impacto Ambiental N.° FEAP-718-1998-SETENA.

El Por Tanto Primero de la Resolución N.° 0320-2020-SETENA revocó ese acto en su totalidad, de manera expresa, inmediata e incondicional. No se trató de una suspensión ni de una modificación parcial. Se suprimió por completo el respaldo jurídico ambiental bajo el cual la empresa ejecutaba su plan de cierre. Esa revocación permaneció, y permanece aún, como declaración jurídica formal vigente, sin que ningún acto posterior la haya dejado sin efecto, explícita ni implícitamente. La Resolución N.° 0872-2020-SETENA, que el Estado presenta como el acto que neutralizó los efectos de la 0320-2020, no restableció en modo alguno el derecho subjetivo extinguido. Sus dos únicos dispositivos son: tomar conocimiento del informe del Ministerio de Salud (Por Tanto Primero) y declarar que la SETENA se allana a las atribuciones de ese Ministerio en el procedimiento de cierre técnico (Por Tanto Segundo). Ninguno de esos dispositivos revoca, anula, deja sin efecto ni sustituye la revocación de la Resolución N.° 2064-2019-SETENA.

La 0872-2020 no aprobó el Plan de Acciones de EBI. No reconoció la cota de 995 m.s.n.m. como parámetro válido. No determinó ninguna vida útil. Simplemente se inhibió de pronunciarse sobre el fondo por falta de competencia, y reconoció que ese pronunciamiento correspondía a otro órgano. En consecuencia, la empresa actora carece hoy de un título jurídico ambiental vigente en el expediente de la SETENA que avale su plan de cierre técnico con la cota aprobada. La única vía para restablecer ese título es la declaración judicial de nulidad de la Resolución N.° 0320-2020-SETENA, que operaría retroactivamente restaurando la vigencia de la Resolución N.° 2064-2019-SETENA. Esa utilidad directa, concreta y personal es, en sí misma, el interés actual que hace viable la demanda. ii. La aprobación del Ministerio de Salud mediante plataforma APC no equivale ni sustituye el título ambiental derivado de la Resolución N.° 2064-2019-SETENA.

El argumento central del Estado descansa sobre una premisa de equivalencia que no tiene sustento en el ordenamiento jurídico: que la aprobación del Ministerio de Salud por vía de la plataforma APC del CFIA cubre la misma materia que la Resolución N.° 2064-2019-SETENA y que, por tanto, la revocación de esta última no genera perjuicio alguno a la actora. Esa equivalencia no existe. El informe de cumplimiento emitido por el Ministerio de Salud el 1 de noviembre de 2019 (proyecto CFIA-884423) avaló los planos constructivos del cierre técnico operativo desde la perspectiva de las competencias propias de ese Ministerio en materia de salud pública y obras de construcción, en el marco del Reglamento sobre Rellenos Sanitarios (Decreto Ejecutivo N.° 38928-S) y la Ley General de Salud. La Resolución N.° 2064-2019-SETENA, en cambio, aprobó el Plan de Acciones como instrumento de gestión ambiental del proyecto, dentro del expediente de Evaluación de Impacto Ambiental que custodia la SETENA y en ejercicio de las potestades que el artículo 19 de la Ley Orgánica del Ambiente N.° 7554 y el Decreto Ejecutivo N.° 31849-MINAE-S-MOPT-MAG-MEIC atribuyen a esa Secretaría.

Las dos coberturas jurídicas operan sobre marcos normativos distintos, provienen de autoridades con competencias no superpuestas, y amparan distintos aspectos de la misma actividad. El propio Por Tanto Tercero de la Resolución N.° 2064-2019-SETENA reconoció la coexistencia de ambas competencias al ordenar notificar la aprobación al Ministerio de Salud para que, con base en sus propias competencias, considerara las obras propuestas durante el proceso de cierre e informara cualquier observación. Si las dos competencias fueran la misma o si una subsumiera a la otra, esa notificación habría sido superflua. No lo era. La empresa actora necesita ambos títulos para operar en plena conformidad jurídica con el ordenamiento, y la revocación de uno de ellos (el de la SETENA) no puede ser suplida por la subsistencia del otro. iii. La vigencia formal de la revocación genera por sí misma una situación de incertidumbre jurídica que constituye un perjuicio actual, directo y concreto.

Aun si se aceptara en hipótesis (lo que este Tribunal no admite) que la aprobación del Ministerio de Salud provee cobertura operativa suficiente para el cierre técnico del PTA Uruka, subsistiría un perjuicio autónomo, actual y concreto derivado de la vigencia formal de la revocación operada por la Resolución N.° 0320-2020-SETENA: la empresa opera en un estado de incertidumbre jurídica respecto de los parámetros de cota admisibles bajo el marco de la SETENA, porque el único acto que los había fijado con rango aprobatorio en ese expediente fue revocado y nunca restituido. Esa incertidumbre no es hipotética ni remota. La propia Resolución N.° 0872-2020-SETENA dejó expresamente a salvo "las facultades de vigilancia que son propias de la Secretaría" (Por Tanto, Segundo). Ello significa que la SETENA se reservó la potestad de fiscalizar y dar seguimiento a la ejecución del cierre técnico, con independencia de que la competencia aprobatoria haya sido reconocida en el Ministerio de Salud.

En ejercicio de esas facultades de vigilancia, cualquier actuación de seguimiento o fiscalización de la SETENA que se produzca en el futuro podría invocar la vigencia de la revocación para cuestionar operaciones realizadas al amparo de los parámetros que la Resolución N.° 2064-2019-SETENA había validado. La empresa no puede oponer ese acto revocado como título de amparo. La inseguridad jurídica que de ello se deriva, y que permanecerá mientras la revocación no sea judicialmente anulada, es un perjuicio real que la empresa sufre en el presente, y que la sentencia anulatoria está llamada precisamente a remover. iv. La tesis del Estado es internamente contradictoria: la propia argumentación que pretende fundar la falta de interés confirma su existencia. Existe una contradicción lógica insalvable en la posición procesal del Estado que, por sí sola, revela la inconsistencia de la excepción. A lo largo de su contestación y conclusiones, el Estado sostiene simultáneamente dos proposiciones incompatibles.

Por un lado, en el primer argumento defensivo, resuelto en el considerando precedente, el Estado afirma que la Resolución N.° 0320-2020-SETENA es un acto de mero trámite sin efectos propios. Si esa proposición fuera cierta, el acto no habría producido ninguna modificación en la esfera jurídica de la actora: no habría extinguido derechos, no habría creado incertidumbre, no habría generado perjuicio alguno. En ese escenario, no habría tampoco nada que "superar" ni ningún interés, ni siquiera potencial, que pudiera verse afectado por la vigencia de ese acto. Por otro lado, y en el mismo expediente, el Estado dedica páginas enteras de su contestación y conclusiones a argumentar que la actora carece de interés actual porque ese mismo acto fue superado por la Resolución N.° 0872-2020-SETENA y por la aprobación del Ministerio de Salud. Pero para que un acto pueda ser "superado", es necesario que haya producido efectos que requirieron ser neutralizados por actos posteriores.

Si la resolución 0320-2020 no hubiera tenido efectos propios, no habría habido nada que superar, y la resolución 0872-2020 habría sido innecesaria. Las dos tesis no pueden coexistir. O bien la Resolución N.° 0320-2020-SETENA carecía de efectos propios, y entonces nunca hubo interés que naciera ni que desapareciera, lo que hace incongruente la excepción de falta de interés actual; o bien sí produjo efectos propios sobre la esfera jurídica de la actora, y entonces la defensa del considerando anterior cae, y el interés actual de la actora en obtener su anulación resulta evidente. El Estado no puede tomar una posición que niega lo que la otra afirma. Esa contradicción intrínseca confirma, por vía negativa, que la empresa actora sí tiene interés actual en la anulación del acto impugnado. C. Conclusión. Aplicado el parámetro del juicio de utilidad que la propia jurisprudencia de la Sala Primera establece, la conclusión es clara: la falta de sentencia sí produce daño y perjuicio a la empresa actora.

La revocación operada por la Resolución N.° 0320-2020-SETENA extinguió derechos subjetivos derivados de la Resolución N.° 2064-2019-SETENA que no fueron restablecidos por ningún acto posterior; la aprobación del Ministerio de Salud mediante plataforma APC no sustituye el título ambiental revocado en el expediente de la SETENA; la vigencia formal de esa revocación genera una situación de incertidumbre jurídica que constituye un perjuicio actual, directo y concreto; y la propia argumentación del Estado incurre en una contradicción interna que confirma la existencia del interés que pretende negar. La excepción de falta de interés actual carece de asidero y debe ser rechazada. En consecuencia, el Tribunal procede a examinar los vicios de nulidad invocados contra la Resolución N.° 0320-2020-SETENA en los considerandos que siguen.

OCTAVO. ANÁLISIS DE FONDO: VICIOS DE NULIDAD ABSOLUTA DE LA RESOLUCIÓN N.° 0320-2020-SETENA. Desestimadas las defensas procesales, corresponde examinar la validez sustantiva de la resolución que se impugna en este proceso. Antes de ingresar al análisis de cada vicio, es necesario destacar que el Estado no impugnó los vicios de fondo invocados por la parte actora desde una perspectiva técnica o probatoria propia. Su contestación de demanda y sus conclusiones se concentraron en dos tesis: que el acto impugnado era de mero trámite sin efecto propio, y que la Resolución N.º 0872-2020-SETENA y la aprobación del Ministerio de Salud habían tornado irrelevante cualquier vicio. Ambas tesis han sido rechazadas en los considerandos precedentes. Al no haber opuesto prueba ni argumento técnico de fondo propio para refutar los vicios concretos denunciados en la demanda, el Estado dejó sin contradicción los hechos que los sustentan.

La única defensa de fondo que el Estado sí desarrolló con algún grado de profundidad, y que coincide con el eje argumentativo del acto impugnado mismo, es la tesis de la vinculación obligatoria a las resoluciones del Tribunal Ambiental Administrativo. Esa tesis es también el argumento principal de la propia Resolución N.° 0320-2020-SETENA, según se evidencia en sus considerandos. Por esa razón, el análisis comienza por ella, pues su desestimación arrastra consigo el fundamento jurídico de todos los demás elementos del acto. Identificados los vicios, se examinarán en el siguiente orden: primero, el error de derecho en el motivo por atribución indebida, de parte de la SETENA, de competencias que no corresponden al Tribunal Ambiental Administrativo; segundo, el error de hecho en el motivo por omisión del Informe SETENA-DT-ASA-1618-2019 y tercero, el vicio en el contenido por imposibilidad material de ejecución.

A. Marco normativo aplicable: elementos del acto administrativo y régimen de nulidad. El acto administrativo, para ser válido, requiere que sus elementos esenciales sean legítimos y conformes al ordenamiento. En lo que interesa al presente caso, el artículo 133 de la Ley General de la Administración Pública establece que el motivo deberá ser legítimo y existir tal y como ha sido tomado en cuenta para dictar el acto; cuando no esté regulado, deberá ser proporcionado al contenido. El artículo 132 dispone que el contenido deberá ser lícito, posible, claro y preciso. El artículo 131 exige que el fin sea público y corresponda al establecido en la norma que atribuye la competencia. El artículo 136 regula la motivación como deber formal de externalizar las razones de hecho y de derecho que determinaron el dictado del acto. La concurrencia de vicios graves en cualquiera de esos elementos determina la nulidad absoluta del acto conforme a los artículos 158 y 166 de la misma ley, con carácter retroactivo desde la fecha de su emisión.

B. Vicio en el motivo. Error de derecho: la SETENA atribuyó al Tribunal Ambiental Administrativo competencias que no le corresponden, e interpretó incorrectamente sus resoluciones N.° 1364-18-TAA y N.° 461-19-TAA. El Considerando de la Resolución N.° 0320-2020-SETENA que sustenta la revocación de la Resolución N.° 2064-2019-SETENA descansa sobre una premisa jurídica única y central: que las resoluciones N.° 1364-18-TAA del 13 de diciembre de 2018 y N.° 461-19-TAA del 25 de marzo de 2019 del Tribunal Ambiental Administrativo ordenaban a la SETENA tener la cota de 985 m.s.n.m. como límite definitivo, absoluto e infranqueable para el proyecto, frente al cual no cabía ninguna modificación técnica posterior. En palabras del propio acto impugnado: "(...) Este asunto no es técnico sino de legalidad, en donde luego del procedimiento ordinario el Tribunal Ambiental Administrativo dicta una resolución fijando la cota para el inicio del cierre técnico del Parque de Tecnología Ambiental La Uruka en 985 msnm que la SETENA debe vigilar conjuntamente con el Ministerio de Salud.

La resolución es un acto firme y definitivo, por lo que, no procede a estas alturas entrar en discusión de su contenido técnico por parte de la SETENA, sino, al acatamiento obligatorio, viéndose compelida a su acatamiento." Esa premisa es incorrecta desde el punto de vista normativo y también textual-interpretativo. Con relación a lo primero, el artículo 111 de la Ley Orgánica del Ambiente N.° 7554 define de manera taxativa las competencias del Tribunal Ambiental Administrativo: conocer y resolver denuncias por violaciones a la legislación tutelar del ambiente, tramitar denuncias de oficio o a instancia de parte por comportamientos activos u omisos que violen o amenacen violar esa legislación, establecer indemnizaciones por daños ambientales, y establecer multas por infracciones. Esas son las únicas competencias que el ordenamiento le atribuye. No existe en esa norma, ni en ninguna otra del ordenamiento ambiental, atribución alguna al Tribunal Ambiental Administrativo para aprobar, denegar, modificar o restringir proyectos de impacto ambiental, sus adendas, sus ampliaciones o sus planes de cierre técnico.

Esa competencia corresponde exclusivamente a la SETENA, de conformidad con los artículos 17 y 83 de la Ley Orgánica del Ambiente, y, en los aspectos de salud pública, al Ministerio de Salud. El Tribunal Ambiental Administrativo es un órgano de resolución de denuncias; no es un órgano de gestión ambiental ni puede actuar como tal. Una resolución del Tribunal Ambiental Administrativo, por más que sea de acatamiento obligatorio en su propio ámbito, no puede crear por vía interpretativa una restricción técnica que el ordenamiento no estableció, ni atribuirle a ese órgano una competencia que la ley no le confiere. Cuando la SETENA concluyó que el TAA había fijado la cota de 985 m.s.n.m. como límite jurídico insuperable, extravió por completo el límite competencial de ese órgano y confundió el objeto de una resolución sancionatoria con el de una autorización técnico-ambiental. Ese error de derecho vició el motivo del acto desde su raíz.

Además de lo anterior, incluso si se prescindiera del argumento competencial, el análisis del texto de las propias resoluciones del Tribunal Ambiental Administrativo revela que la lectura que hizo la SETENA es incorrecta. La Resolución N.° 1364-18-TAA del 13 de diciembre de 2018 ordenó al Ministerio de Salud, en coordinación con la SETENA, "mantener estricta vigilancia sobre la medición topográfica, para que una vez alcanzada la cota 985 msnm se giren las instrucciones técnicas para que se proceda con el proceso de cierre técnico, conforme a Derecho corresponde." La cláusula final es la que la SETENA pasó por alto: "conforme a Derecho corresponde." Esa expresión no es un agregado retórico; es una remisión expresa al marco jurídico ordinario de competencias. El TAA no ordenó que el cierre se ejecutara bajo las condiciones de la cota de 985 m.s.n.m. como límite técnico inamovible. Lo que dispuso fue, que una vez alcanzada esa cota, que era la referencia de planificación que la propia empresa había autoimpuesto, se procediera con el proceso de cierre técnico conforme al ordenamiento aplicable.

El cómo hacerlo era precisamente la materia técnica competencia de la SETENA y del Ministerio de Salud. La Resolución N.° 461-19-TAA del 25 de marzo de 2019 fue aún más explícita. Al resolver la solicitud de adición y aclaración de la empresa, el Tribunal Ambiental Administrativo expresó: "(...) Si bien es cierto, existe una cota fijada en 985 msnm, como límite para que se proceda con el cierre técnico... quedó debidamente acreditado... que la cota máxima del proyecto puede variar, según los procedimientos establecidos al efecto..." Ese reconocimiento textual del TAA, que la cota podía variar según los procedimientos de ley, es incompatible de manera absoluta con la lectura que hizo la SETENA en la Resolución N.° 0320-2020. La SETENA tuvo ese texto ante sí. El propio Considerando Sexto del acto impugnado cita la Resolución N.° 1364-18-TAA. Sin embargo, eligió ignorar la cláusula "conforme a Derecho corresponde" y la declaración del TAA sobre variabilidad de la cota, y construyó su motivación sobre una lectura que ninguno de esos textos autoriza.

El error de derecho en el motivo resulta, así, doblemente demostrado: la SETENA invocó como fundamento jurídico de su acto una competencia que el TAA no tiene, y le atribuyó a las resoluciones de ese Tribunal un alcance prohibitivo que sus propios textos expresamente niegan. Ese vicio es grave, insalvable y determina la ilegitimidad del motivo conforme al artículo 133, inciso 1, de la Ley General de la Administración Pública. C. Vicio en el motivo. Error de hecho: omisión del Informe SETENA-DT-ASA-1618-2019. Existe un segundo vicio en el motivo, independiente del anterior y de igual gravedad, que se desprende de la secuencia procedimental interna de la propia SETENA. El 2 de diciembre de 2019, el Departamento Legal de la SETENA, mediante oficio SETENA-AJ-0712-2019, solicitó expresamente al Departamento de Auditoría y Seguimiento Ambiental que emitiera criterio técnico para resolver el recurso de revocatoria interpuesto por la señora Melissa Flores Núñez contra la Resolución N.° 2064-2019-SETENA.

Esa solicitud de criterio consta en los hechos probados de esta sentencia y fue reconocida por la propia Resolución N.° 0320-2020-SETENA en su Considerando Décimo Segundo. El Departamento de Auditoría y Seguimiento Ambiental cumplió con lo solicitado y emitió el Informe SETENA-DT-ASA-1618-2019 el 13 de diciembre de 2019, suscrito por el Coordinador a.i. Ing. Alejandro González Barquero y el especialista ambiental M.Sc. Ing. Oscar Umaña Fernández. Sus conclusiones fueron las siguientes: primero, la cota de 985 m.s.n.m. fue autoimpuesta por el desarrollador con base en la información técnica del momento y no fue establecida por ninguna instancia gubernamental como resultado de un estudio de capacidad soportante; segundo, el aumento a 995 m.s.n.m. surge de los estudios técnicos de INSUMA S.A. que determinaron, con factor de seguridad adecuado y sin riesgo para la estabilidad del relleno, que la altura podía modificarse hasta esa cota; tercero, la capacidad de recibo de un relleno sanitario es variable y depende de factores múltiples que requieren estudios continuos; cuarto, la cota de 985 m.s.n.m. fue una medida de planificación interna vigente para el momento en que fue autoimpuesta, no porque representara un valor de riesgo o peligro para el proyecto.

El informe era, en suma, rotundamente favorable a mantener los efectos de la Resolución N.° 2064-2019-SETENA y corroboraba con autoridad técnica institucional propia los argumentos de la parte actora. Su relevancia para la toma de decisión, además, era máxima, dado que había sido solicitado específicamente para ese fin. La Resolución N.° 0320-2020-SETENA guardó silencio absoluto sobre ese informe. No lo cita, no lo valora, no lo transcribe, no lo distingue, no lo descarta con argumento alguno. El Considerando Décimo Segundo del acto impugnado reconoce que se solicitó el criterio al Departamento de Auditoría, pero a continuación el texto de la resolución salta directamente a otras consideraciones sin consignar qué resultó de esa solicitud. Es como si el informe nunca hubiera existido. La supresión es total. Esa omisión vicia el motivo de manera grave e independiente. El artículo 133 de la LGAP exige que el motivo exista tal y como ha sido tomado en cuenta para dictar el acto.

Cuando la Administración solicita un criterio técnico como insumo para resolver y luego lo suprime de su razonamiento sin explicación alguna, el motivo declarado no corresponde al motivo real: se oculta la prueba que contradice la decisión adoptada. La resolución habría debido valorar ese informe, asumirlo si lo consideraba correcto, o descartarlo con fundamento técnico propio si lo estimaba equivocado. Al no haber hecho ninguna de las dos cosas, se ha resuelto con prescindencia total de un elemento de juicio determinante, lo que constituye un vicio en el motivo que genera nulidad absoluta del acto. A mayor abundamiento, el oficio MS-DPRSA-255-2020 del 27 de febrero de 2020, emitido por el Ministerio de Salud apenas seis días después de dictada la Resolución N.° 0320-2020-SETENA, en respuesta al oficio SETENA-SG-0328-2020 del 26 de febrero de 2020 con que la propia SETENA le solicitó criterio, llegó a confirmar, de manera independiente y desde la autoridad del órgano rector en la materia, exactamente lo mismo que el Informe ASA-1618-2019 había concluido: que la cota aprobada para las celdas del relleno sanitario era de 995 m.s.n.m. y que esa elevación era parte de las obras de cierre técnico operativo avaladas por la Resolución N.° 2064-2019-SETENA.

El hecho de que ese pronunciamiento fuera posterior al acto impugnado impide imputarlo como vicio de omisión de la 0320-2020; sin embargo, su contenido tiene valor como prueba de confirmación retroactiva: demuestra que el criterio técnico que la SETENA suprimió al dictar el acto no era una opinión aislada sino la posición institucional del Ministerio de Salud, corroborada en el momento en que se le preguntó formalmente. D. Vicio en el contenido. Imposibilidad material de ejecución. El Por Tanto Segundo de la Resolución N.° 0320-2020-SETENA instruyó al Ministerio de Salud a establecer los parámetros del cierre técnico del PTA Uruka "con respecto a la cota 985 msnm", e indicar los nuevos lineamientos para que el desarrollador presentara el Plan de Acciones de Cierre Operativo. El artículo 132, inciso 1, de la LGAP dispone que el contenido del acto administrativo deberá ser, entre otras condiciones, posible.

El contenido que impone una obligación o establece un marco de actuación cuya ejecución es materialmente imposible viola ese requisito y determina la nulidad del acto. La prueba documental que obra en el expediente, en particular el Informe SETENA-DT-ASA-1618-2019 y el Informe SETENA-DT-ASA-274-2020 del 11 de marzo de 2020, ambos emitidos por el propio Departamento de Auditoría y Seguimiento Ambiental de la SETENA, acredita que al momento de dictarse la Resolución N.° 0320-2020-SETENA el relleno sanitario PTA Uruka ya operaba en cotas superiores a los 985 m.s.n.m. La cota de 985 m.s.n.m. no era un parámetro futuro que pudiera alcanzarse, sino que era un umbral ya físicamente superado. El propio Considerando Sexto de la Resolución N.° 0320-2020-SETENA reconoció que esa cota había sido autoimpuesta por el desarrollador como medida de planificación interna y no determinada como requisito de altura por la SETENA ni por el Ministerio de Salud.

Ordenar que el cierre técnico se ejecute con respecto a una cota ya superada de hecho equivale a ordenar algo que no puede hacerse sin retrotraer físicamente la realidad del proyecto. Esa imposibilidad material no es de grado ni de dificultad, sino que es absoluta. El contenido del acto impugnado era, desde su emisión, de ejecución imposible, lo que lo vicia de nulidad absoluta conforme al artículo 132 de la LGAP. E. Conclusión. La concurrencia de los vicios de nulidad en el acto impugnado: error de derecho en el motivo por atribución indebida, de parte de la SETENA, de competencias que no corresponden al Tribunal Ambiental Administrativo e interpretación incorrecta de sus resoluciones; error de hecho en el motivo por omisión del Informe SETENA-DT-ASA-1618-2019 y vicio en el contenido por imposibilidad material de ejecución; determina, de conformidad con los artículos 158 y 166 de la Ley General de la Administración Pública, la nulidad absoluta de la Resolución N.° 0320-2020-SETENA de las 10:00 horas del 21 de febrero de 2020.

No son vicios de forma que pudieran convalidarse ni deficiencias que admitieran subsanación procedimental, sino que se trata de vicios graves que afectan elementos esenciales del acto de manera insalvable. La declaratoria de nulidad absoluta produce efectos retroactivos desde la fecha de emisión del acto, conforme al artículo 171 de la LGAP. Ello significa que la Resolución N.° 0320-2020-SETENA debe tenerse por no dictada, y que la Resolución N.° 2064-2019-SETENA recupera su plena vigencia y eficacia jurídica desde la fecha de su emisión original el 28 de junio de 2019, con todos los derechos subjetivos que de ella emanaron para la parte actora. La nulidad declarada alcanza también a los actos conexos impugnados. En particular, la Resolución N.° 0794-2020-SETENA que rechazó el recurso de revocatoria interpuesto por la actora es un acto conexo cuya existencia y fundamento derivan directamente de la validez de la Resolución N.° 0320-2020-SETENA: declarada nula esta última, aquella pierde su objeto y cae con ella. Por las razones expuestas, la demanda debe declararse con lugar en todos sus extremos y así se dispone.

NOVENO. EXCEPCIONES DE FALTA DE LEGITIMACIÓN ACTIVA Y PASIVA Y FALTA DE DERECHO. El Estado opuso en su contestación de demanda, de manera conjunta y sin desarrollo argumentativo propio, la excepción de falta de legitimación activa y pasiva. La excepción fue enunciada en la petitoria sin que en ningún apartado de la contestación ni de las conclusiones se expusieran las razones de hecho o de derecho que, en su criterio, sustentarían la ausencia de cualquiera de esas dos condiciones en los sujetos procesales de este litigio. Esa omisión argumentativa, por sí sola, impide que la excepción prospere; pero en todo caso, el análisis de los presupuestos de legitimación a partir de lo que obra en autos conduce a la misma conclusión. Legitimación activa. La parte actora, Empresas Berthier EBI de Costa Rica S.A., es la titular en el expediente de Evaluación de Impacto Ambiental N.° FEAP-718-1998-SETENA y la desarrolladora del proyecto Parque de Tecnología Ambiental Uruka.

La Resolución N.° 0320-2020-SETENA revocó en su perjuicio la Resolución N.° 2064-2019-SETENA, acto que le había reconocido el Plan de Acciones para el Cierre Operativo del PTA Uruka y la cota de operación de 995 m.s.n.m. La empresa es, por tanto, la destinataria directa e inmediata de los efectos ablativos del acto impugnado: es titular de un derecho subjetivo extinguido por ese acto y su esfera jurídica fue afectada de manera directa, personal y cierta. Conforme al artículo 10, inciso 1, apartado a), del Código Procesal Contencioso Administrativo, la legitimación activa corresponde a quien invoque la titularidad de un derecho subjetivo o un interés legítimo afectado por la conducta administrativa impugnada. Ambas condiciones concurren en la actora sin margen de discusión. Legitimación pasiva. La SETENA (Secretaría Técnica Nacional Ambiental) es un órgano desconcentrado en grado máximo del Ministerio del Ambiente y Energía, creado mediante el artículo 83 de la Ley Orgánica del Ambiente N.° 7554, con competencia exclusiva e independencia funcional en el desempeño de sus atribuciones.

Al carecer de personalidad jurídica propia, las actuaciones de la SETENA se imputan al Estado como sujeto de derecho público. En consecuencia, el aquí demandado es el sujeto pasivo idóneo en este proceso, conforme al artículo 12, inciso 1, del Código Procesal Contencioso Administrativo, que establece que será parte demandada la Administración autora de la conducta impugnable. En consecuencia, tanto la legitimación activa de la parte actora como la legitimación pasiva del Estado se encuentran debidamente acreditadas en autos y se ajustan sin dificultad a los parámetros del ordenamiento. La excepción carece de sustento fáctico y jurídico y debe ser rechazada. De igual manera, por lo dicho en el Considerando anterior, se rechaza la excepción de falta de derecho, al quedar acreditado que a la actora le asiste el derecho que invocó en su libelo de demanda.

DÉCIMO. COSTAS: De conformidad con el numeral 193 del CPCA, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En este asunto, no encuentra el Tribunal que resulten aplicables a la especie ninguna de las causales de exención referidas, por lo que se condena al Estado, como parte vencida, a pagar a favor de la actora, las costas de esta acción, junto con los intereses que éstas produzcan desde su fijación y hasta su efectivo pago, conforme fue solicitado en las pretensiones, a liquidar en etapa de ejecución de sentencia.

POR TANTO:

Se rechazan las excepciones de acto no susceptible de impugnación, falta de interés actual, falta de legitimación activa y pasiva y falta de derecho opuestas por el Estado. Se declara con lugar la demanda en todos sus extremos. Se declara la nulidad absoluta de la Resolución No. 0320-2020-SETENA dictada a las 10:00 horas del 21 de febrero de 2020, adoptada por la Comisión Plenaria de SETENA mediante artículo No. 2 de la Sesión Ordinaria No. 017-2020 del 25 de febrero de 2020, así como de la Resolución No. 0794-2020-SETENA, dictada a las 09 horas 45 minutos del 29 de abril del 2020, adoptada por la Comisión Plenaria de la SETENA en Sesión Ordinaria No. 034-2020, Artículo No. 17, por su carácter conexo con la anterior. Se condena al Estado al pago de ambas costas de la acción, junto con los intereses que éstas produzcan desde su fijación y hasta su efectivo pago, a liquidar en etapa de ejecución de sentencia.
