MUNICIPAL COUNCIL OF PUERTO JIMÉNEZ N° 2026003861 ADMINISTRATIVE CONTENTIOUS AND CIVIL TREASURY COURT, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at thirteen hours and fifty-three minutes on the twelfth of June, two thousand and twenty-six.
This Court, acting as non-hierarchical legality supervisor (contralor no jerárquico de legalidad) over municipal affairs, takes cognizance of the mayoral veto filed by Mr. Enrique Segnini Saballo, national identification number: 5-0248-0033, in his capacity as Municipal Mayor (Alcalde Municipal), against Resolutions (acuerdos) numbers 12 and 13 adopted at Ordinary Session number 77, held on January thirty-first, two thousand and twenty-six, by the Municipal Council (Concejo Municipal) of Puerto Jiménez.
The opinion is written by Judge Solís Valverde; and
WHEREAS
Of relevance to this decision, the following facts are deemed established:
For purposes of analyzing the matter before this Court, it is worth recalling that, pursuant to Article 173 of the Political Constitution (Constitución Política), as developed in Articles 162, 165, 166, 167, 170, and 171 of the Municipal Code and Articles 189 and following of the Administrative Contentious Procedural Code (Código Procesal Contencioso Administrativo), the jurisdiction of the Administrative Contentious Court to act as non-hierarchical legality supervisor over the municipal system is defined. This jurisdiction, pursuant to Article 181 of the General Law of Public Administration (Ley General de la Administración Pública), is limited to exercising a review that is purely one of legality over the formal functioning of municipal corporations (corporaciones municipales), and is confined to verifying control over the administrative decisions of the municipalities issued by their authorities — namely, the Council and the Mayor — within the limits of the claims and factual issues raised by the appealing party.
In the case at hand, the Court is seized of a veto directed against Resolutions numbers 12 and 13 adopted at Ordinary Session number 77 on January thirty-first, two thousand and twenty-six, which read as follows: "(...) RESOLUTION N°12: The Municipal Council of Puerto Jiménez agrees to accept recommendation CP-ZMT-2026-2401-01. By simple majority, THIS IS DEFINITIVELY APPROVED; RESOLUTION IN FULL FORCE. RESOLUTION N°13: The Municipal Council of Puerto Jiménez agrees to approve the opinion set forth in memorandum CP-ZMT-2026-2401-01. By simple majority, THIS IS DEFINITIVELY APPROVED; RESOLUTION IN FULL FORCE." (pages 983 to 986 of the main case file); a veto that was considered by means of Article IX, Sub-item -15) of Ordinary Session number 78-2026, held on February 7, two thousand and twenty-six, where it was agreed: "(...) Consequently, the Honorable Municipal Council of Puerto Jiménez rejects veto N° AM-PJ-VTO-001-2026 filed by Mayor Enrique Seginini Saballo." (pages 1002 to 1003 of the main case file); both acts being issued by the Municipal Council.
In that regard, and given the manner in which this matter is resolved, it is important to transcribe the relevant portions of recommendation CP-ZMT-2026-2401-01, which the vetoed act agreed to accept, and which in summary provides: "(...) RECOMMENDATION RESOLUTION N°01: Therefore, this commission recommends to the Municipal Council that both case files be returned to the Municipal Administration, since, based on the documentation reviewed, it is observed that the matter is a 'CONCLUDED SITUATION' and that case file PU-7159-2014, in the name of Mr. Rolando Muñoz Contreras, be archived. Put to a vote. By absolute majority vote, the recommendation is approved and this resolution is ordered FINAL AND DEFINITIVELY APPROVED. RESOLUTION N°02: Therefore, this commission recommends to the Municipal Council that the head of the municipal administration be instructed to carry out the corresponding administrative enforcement actions in accordance with applicable regulations and the principle of administrative competence set forth in Article N°04 of the General Law of Public Administration.
By absolute majority vote, the recommendation is approved and this resolution is ordered FINAL AND DEFINITIVELY APPROVED. (...)." (pages 983 to 986 of the main case file). With the foregoing clearly established, this collegiate body proceeds to enumerate the two specific reasons that explain the decision adopted.
IN THE FIRST PLACE: it is important to highlight — specifically with regard to the Municipal Council's resolution that considered and rejected the veto filed by the Municipal Mayor's Office, as transcribed in the Minutes of Ordinary Session N°78-2026, Article IX, Sub-item-15, pages 19 to 37, in which the vote to reject the veto is recorded (pages 1064 to 1082 of the main case file) — that the minutes begin with a verbatim transcription of the veto filed, followed by the transcription of the intervention by councilmember (regidor) Yosar Flores, who in summary stated that the filing looked more like an appeal filed by Mr. Rolando than a veto; that the matter had already been resolved by the Municipality of Golfito; that if they were dissatisfied, they should take action before the Municipal Council of Golfito, because the matter had already been settled; that what the Council does is ratify what already existed, that it is not a new resolution, and that they cannot address the merits because the deadlines and remedies had expired.
The Municipal President then intervened, indicating that the councilmember had clarified the situation, and noted that the Maritime-Terrestrial Zone official "brought the dead back to life," because the case had already been closed. He argued that the veto bore more of the characteristics of a petition for review (recurso de revisión) and that it was Mr. Contreras who should have filed it, reiterating that what was being done was merely ratifying a resolution adopted by the Municipality of Golfito. The vote on the rejection of the veto was then taken (see pages 1064 to 1082 of the record). Now, having analyzed the content of Article IX, Sub-item -15) of Ordinary Session number 78-2026, held on February 7, two thousand and twenty-six, where it was agreed: "(...) Consequently, the Honorable Municipal Council of Puerto Jiménez rejects veto N° AM-PJ-VTO-001-2026 filed by Mayor Enrique Seginini Saballo." (pages 1002 to 1003 and 1064 to 1082 of the main case file), this Court determines that the factual and legal arguments set forth by the Mayor in the veto now before this appellate instance have not been considered or analyzed by the Municipal Council.
Note that the resolution rejecting the veto does nothing more than deny approval of the veto based on subjective arguments made by one councilmember and the President of the Council, and refer it to this Court — all without any technical or legal analysis of the grounds for adopting this resolution. It is worth noting that the defects alleged in the veto are not technically or reasonably substantiated — such as: violation of the principle of impartiality and conflict of interest on the part of the municipal attorney, violation of Articles 230, 236, and 113 of the General Law of Public Administration, violation of Art. 3 of the Law Against Corruption and Illicit Enrichment (Ley contra la Corrupción y el Enriquecimiento Ilícito), violation of Art. 44 of the Maritime-Terrestrial Zone Law (Ley de Zona Marítimo Terrestre), violation of constitutional due process (debido proceso) for failure to provide a hearing to the regulated party (administrado), defects in the procedure for the permit granted to Ms.
Porras Quirós, matters relating to eviction moratoria, violation of the principle of legal certainty (principio de seguridad jurídica), violation of the principle of first-in-time, first-in-right (principio primero en tiempo primero en derecho), and violation through administrative inaction constituting a denial of justice — none of these grievances are even identified in the administrative act (acto administrativo) that considers the veto, much less do they form the basis for its rejection. In other words, the Municipal Council's resolution considering the veto referred to this Court does not analyze — from any perspective — the arguments set forth in the veto. In light of this situation, it is the view of this collegiate body that the Municipal Council of Puerto Jiménez must proceed to consider whether the veto filed by the Municipal Mayor's Office should or should not be granted — that is, it must address, on the merits, each and every one of the grievances raised. Along these lines, this Court concludes that such omission — or, rather, such lack of reasoning — is injurious to due process for the following reasons:
IN THE SECOND PLACE, and as a further basis for the decision adopted by this appellate instance, the vetoed resolution is one that accepted recommendation CP-ZMT-2026-2401-01, whereby it was agreed to return two administrative case files to the Municipal Administration so that case file PU-7159-2014, in the name of Mr. Rolando Muñoz Contreras, be archived and so that Ms. Norma Porras Quirós be placed in enjoyment of the property subject to case file PU-7302-2015 (pages 974 to 975 and 983 to 985 of the main case file). In light of the foregoing, although a veto has been elevated for consideration by this Court, this collegiate body has detected a potential violation of the Principle of Due Process, given that there is no record in the file that the private individuals who processed administrative case files addressed in the resolution at issue — case file PU-7159-2014 in the name of Mr. Rolando Muñoz Contreras and case file PU-7302-2015 in the name of Ms.
Norma Porras Quirós — were recognized by the Municipal Council as procedural parties for the defense of their rights in the proceeding when the veto against the analyzed act was resolved; and that their integration as third parties before this instance does not cure such procedural omission, since what is before the Court is a veto of an administrative act relating to the granting of a land-use permit (permiso de uso de suelo) in the Maritime-Terrestrial Zone and the archiving of a case file related to a proceeding in that same area. In accordance with the foregoing, it is important to highlight the provisions of Article 182 of the General Law of Public Administration, which states: "Article 182.—1. The Judge may not declare the invalidity of the act ex officio, except where there are substantial violations relating to the subject, the procedure, or the form, in which cases the Judge shall be required to do so.
(...)" (emphasis not in the original); a provision that must be read in relation to Article 223 of the same law, which provides: "Article 223.—1. Only the omission of substantial procedural formalities will cause the nullity (nulidad) of what has been done. 2. A formality shall be understood as substantial when its correct fulfillment would have prevented or changed the final decision in important respects, or when its omission caused defenselessness." (emphasis not in the original); provisions that must further be understood in harmony with the clear content of Article 239 of the same law, which addresses notice to all parties involved in the administrative proceeding: "Article 239.—Every procedural act that affects the rights or interests of the parties or of a third party must be duly communicated to the affected party, in accordance with this Law." (emphasis not in the original). Thus, in accordance with the foregoing and by analogy, what may properly be considered in safeguarding the Right to Due Process set forth in Art. 41 of the Political Constitution and Art. 8 of the American Convention on Human Rights is that the Municipal Council should have recognized — prior to considering the veto filed — as procedural parties all persons who had acquired any right or legitimate interest through the administrative act subject to the veto, so that they could be given a hearing and the opportunity to defend their interests and rights, which could potentially be affected by the grievances raised in the veto.
Accordingly, the integration of third parties must occur at the municipal level so that, in the event the veto is ultimately upheld, those who had acquired any legitimate interest or right from the challenged act will have had the opportunity to be heard; all of this with the purpose of guaranteeing them the Fundamental Right to Due Process and, as part thereof, the procedural guarantee of being heard, protected by Art. 41 of the Political Constitution and Art. 8 of the American Convention on Human Rights. In that regard, since it is an uncontested fact that the private individuals Rolando Muñoz Contreras and Norma Porras Quirós were not recognized by the Municipal Council as procedural parties for the defense of their interests in the proceeding when it considered the veto filed against the challenged resolution, this Court is compelled to declare ex officio the nullity — on grounds of form and without prejudging the merits — of the administrative act issued by the Municipal Council contained in Article IX, Sub-item -15) of Ordinary Session number 78-2026, held on February 7, two thousand and twenty-six, by which the veto filed was resolved, on the basis of Articles 158, 182, 223, and 239 of the General Law of Public Administration.
Consequently, and in light of the manner in which this matter is resolved, in accordance with the nullity declared in this ruling, the Municipal Council must guarantee, as part of the appeal proceeding, due process, for which it must observe at a minimum the following:
III.Since these proceedings have been conducted before this Court in electronic form, the parties may obtain a complete copy containing both the administrative record submitted by the Municipal Corporation and all of the documents comprising the present appellate proceeding, for which they must provide an electronic storage device (USB drive or compact disc). Likewise, should any physical or electronic documentation (plans, photographs, reports, etc.) remain in the custody of this Court, the party who submitted it may retrieve it within a period of 30 business days, in accordance with Art. 12 of the «Regulations on Electronic Case Files before the Judiciary», approved by the Full Court (Corte Plena) at session n.° 27-11 of August 22, 2011, Article XXVI, and published in Judicial Gazette (Boletín Judicial) n.° 19 of January 26, 2012, as well as the resolution approved by the Superior Council of the Judiciary (Consejo Superior del Poder Judicial) at session n.° 43-12, held on May 3, 2012, Article LXXXI.

On the basis of Articles 158, 182, 223, and 239 of the General Law of Public Administration, the ruling contained in the administrative act issued by the Municipal Council of Puerto Jiménez, Article IX, Sub-item -15) of Ordinary Session number 78-2026, held on February 7, two thousand and twenty-six, by the Municipal Council — by which the veto filed against Resolutions numbers 12 and 13 adopted at Ordinary Session number 77 on January thirty-first, two thousand and twenty-six, by the Municipal Council of Puerto Jiménez is rejected — IS HEREBY ANNULLED ex officio. The Municipal Council is hereby ordered to take note of all that is set forth in Considerando II of this ruling. Once the following persons have been joined to the municipal proceeding: Mr. Rolando Muñoz Contreras (case file PU-7159-2014) and Ms. Norma Porras Quirós (case file PU-7302-2015), and once the time period granted in the hearing regarding the veto filed against Resolutions numbers 12 and 13 adopted at Ordinary Session number 77 on January thirty-first, two thousand and twenty-six, by the Municipal Council of Puerto Jiménez has elapsed, the Municipal Council must promptly resolve the veto filed, enumerating and resolving each and every one of the grievances and claims raised, as well as all counterarguments submitted by all parties involved.
Once the points ordered herein have been fulfilled, the Municipal Council must proceed with the steps required by law. In light of the manner in which this matter is resolved, no specific ruling is made on the grievances raised in the veto filed. That is all. Notify the parties. CONCEJO MUNICIPAL DE PUERTO JIMÉNEZ N° 2026003861 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las trece horas con cincuenta y tres minutos del doce de Junio del dos mil veintiseis.- Conoce este Tribunal como contralor no jerárquico de legalidad, del Veto interpuesto por el señor Enrique Segnini Saballo, cédula: 5-0248-0033 en su condición de Alcalde Municipal, en contra de los Acuerdos números 12 y 13 adoptados en la Sesión Ordinaria número 77 del treinta y uno de enero del año 2026 por el Concejo Municipal de Puerto Jiménez.- Redacta la Jueza Solís Valverde y;
CONSIDERANDO
De interés para la resolución; se tienen por acreditados los siguientes hechos:
A efectos de analizar la gestión que se conoce, es conveniente recordar, que conforme al enunciado del artículo 173 de la Constitución Política, desarrollado en los numerales 162, 165, 166, 167, 170 y 171 del Código Municipal y 189 y siguientes del Código Procesal Contencioso Administrativo, se define la competencia del Tribunal Contencioso Administrativo para actuar como contralor no jerárquico de legalidad del régimen municipal, lo cual, conforme al numeral 181 de la Ley General de la Administración Pública, se circunscribe a ejercer un control eminentemente de legalidad de la función formal de las corporaciones municipales, en tanto se limita a verificar un control de las decisiones administrativas de las Municipalidades, emanadas de sus autoridades, sea, del Concejo y del Alcalde, dentro del límite de las pretensiones y cuestiones de hecho planteadas por la parte recurrente. En el caso que nos ocupa, se conoce veto que recae en contra de los Acuerdos números 12 y 13 adoptados en la Sesión Ordinaria número 77 del treinta y uno de enero del año 2026, mismos que indican: "(...) ACUERDO N°12: El Concejo Municipal de Puerto Jiménez acuerda acoger la recomendación CP-ZMT-2026-2401-01.
Por mayoría simple QUEDA DEFINITIVAMENTE APROBADO; ACUERDO EN FIRME. ACUERDO N°13: el Concejo Municipal de Puerto Jiménez acuerda aprobar lo dictaminado en el oficio CP-ZMT-2026-2401-01. Por mayoría simple QUEDA DEFINITIVAMENTE APROBADO; ACUERDO EN FIRME." (folios 983 a 986 del expediente principal); veto que fue conocido por medio del Artículo IX, Inciso -15) de la Sesión Ordinaria número 78-2026 celebrada el 7 de febrero del año 2026, donde se acordó: "(...) En consecuencia, el Honorable Concejo Municipal de Puerto Jiménez rechaza el veto N° AM-PJ-VTO-001-2026 interpuesto por el señor alcalde Enrique Seginini Saballo." (folios 1002 a 1003 del expediente principal); ambos actos emanados del Concejo Municipal. En dicho sentido y por la forma en como se resuelve es importante transcribir en lo de interés que establece la recomendación CP-ZMT-2026-2401-01, que se acuerda acoger por medio del acto vetado y al respecto en resumen indica: "(...) RECOMENDACIÓN ACUERDO N°01 Por lo tanto, esta comisión recomienda al Concejo Municipal devolver ambos expedientes a la Administración Municipal, ya que con base en la documentación revisada se observa que es "SITUACIÓN CONCLUIDA" y se archive el expediente PU-7159-2014 , a nombre del señor Rolando Muñoz Contreras.
Se somete a votación. Por votación de mayoría absoluta se aprueba la recomendación y se dispone este acuerdo en FIRME Y DEFINITIVAMENTE APROBADO. ACUERDO N°02 Por lo tanto, esta comisión recomienda al Concejo Municipal, que se le instruya al titular de la administración municipal que realice las actuaciones ejecutorias administrativas que correspondan conforme con la normativa aplicable y al principio de competencia administrativa. Consagrado en el numeral N°04 de la Ley General de la Administración Pública. Por votación de mayoría absoluta se aprueba la recomendación y se dispone este acuerdo en FIRME Y DEFINITIVAMENTE APROBADO. (...)." (folios 983 a 986 del expediente principal). Teniendo claro lo anterior, se procede por parte de este órgano colegiado a enumerar las dos razones puntuales que permiten explicar la decisión adoptada. EN PRIMER ORDEN: es importante destacar propiamente y sobre el acuerdo del Concejo Municipal que conoce y rechaza el veto interpuesto por la Alcaldía Municipal, transcrito en el Acta de la Sesión Ordinaria N°78-2026, artículo IX, Inciso-15, páginas 19 a 37, en el cual se registra la votación del rechazo del veto (folio 1064 a 1082 del expediente principal), que el acta inicia con una transcripción literal del veto interpuesto, seguidamente se transcribe la intervención del regidor Yosar Flores, donde en resumen señala dicho regidor, que más que un veto parece que se presenta un recurso interpuesto por el señor Rolando, refiere que el tema ya fue resuelto por la Municipalidad de Golfito, y que si no estaban conformes debían accionar ante el Concejo Municipal de Golfito, porque era algo que ya se encontraba resuelto, señala que el Consejo lo que hace es ratificar lo que ya existía y que no es un acuerdo nuevo y que no pueden conocer el fondo porque ya se vencieron los plazos y los recursos.
Posteriormente interviene el Presidente Municipal quien indica que el regidor deja clara la situación e indica que el funcionario de Zona Marítimo Terrestre "revive al muerto", porque el caso ya estaba cerrado. Aduce que, el veto tiene más características de un recurso de revisión y que quien debía interponerlos era el señor Contreras y reitera que lo que se hace es ratificar un acuerdo que tomo la Municipalidad de Golfito. Acto seguido se vota por el rechazo del veto (ver folios 1064 a 1082 de los autos). Ahora bien, analizado el contenido del Artículo IX, Inciso -15) de la Sesión Ordinaria número 78-2026 celebrada el 7 de febrero del año 2026, donde se acordó: "(...) En consecuencia, el Honorable Concejo Municipal de Puerto Jiménez rechaza el veto N° AM-PJ-VTO-001-2026 interpuesto por el señor alcalde Enrique Seginini Saballo." (folios 1002 a 1003 y 1064 a 1082 del expediente principal), es que este despacho determina que los argumentos de hecho y de derecho que fueron expuestos por el señor Alcalde en el veto que se conoce por esta alzada, no han sido conocidos ni analizados por el Concejo Municipal.
Véase que el Acuerdo que rechazó el veto interpuesto, lo que hace es denegar la aprobación del veto interpuesto con base en argumentaciones subjetivas realizadas por un regidor y el Presidente del Concejo y remitirlo ante este despacho; lo anterior, sin ningún tipo de análisis técnico-jurídico del porque se adopta este acuerdo. Nótese que no se fundamenta de manera técnica ni razonada los vicios alegados en el veto como lo son: violación al principio de imparcialidad y conflicto de interés de la abogada municipal, violación de los artículos 230, 236, 113 de la Ley General de la Administración Pública, violación al artículo 3 de la Ley contra la Corrupción y el Enriquecimiento Ilícito, violación al artículo 44 de la Ley de Zona Marítimo Terrestre, violación al debido proceso constitucional por falta de audiencia al administrado, vicios en el procedimiento del permiso otorgado a la señora Porras Quirós, lo referente a las moratorias de desalojos, violación al principio de seguridad jurídica, violación al principio primero en tiempo primero en derecho, violación por inacción administrativa constitutiva de denegación de justicia, es decir, estos agravios ni siquiera son identificados en el acto administrativo que conoce del veto, menos aún fundamentan su rechazo.
Es decir, el acuerdo del Concejo Municipal que conoce el veto que se remite ante este despacho, no analiza desde ninguna óptica los argumentos del veto planteado. En razón de la situación expuesta, es criterio de este colegio que el Concejo Municipal de Puerto Jiménez, debe proceder a conocer de la procedencia o no del veto planteado por la Alcaldía Municipal, es decir, debe conocer por el fondo de la procedencia o no de todos y cada uno de los agravios expuestos. En este línea de pensamiento, este Tribunal concluye que tal omisión, o bien tal falta de motivación, es lesiva al debido proceso por las siguientes razones:
III.Al haberse sustanciado esta sede en forma electrónica, queda a disposición de las partes obtener una copia integral que contiene tanto el expediente administrativo remitido por la Corporación Municipal así como la totalidad de las piezas que conforman la presente alzada, para lo cual deberá aportar el dispositivo electrónico de almacenamiento (llave maya o disco compacto). Asimismo, en caso que hubiere ingresado documentación física o electrónica (planos, fotografías, informes, etc) que permanezca aún en custodia el Despacho, podrá retirarla quien la aportó en un plazo de 30 días hábiles, de conformidad con lo dispuesto en el artículo 12 del «Reglamento sobre Expediente Electrónico ante el Poder Judicial», aprobado por la Corte Plena en sesión n.° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial n.° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión n.° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.-
POR TANTO
Con fundamento en los artículos 158, 182, 223 y 239 de la Ley General de la Administración Pública, de oficio SE ANULA la resolución contenida en el acto administrativo dictado por el Concejo Municipal de Puerto Jiménez, Artículo IX, Inciso -15) de la Sesión Ordinaria número 78-2026 celebrada el 7 de febrero del año 2026 por el Concejo Municipal, donde se rechaza el veto interpuesto en contra de los acuerdos números 12 y 13 adoptados en la Sesión Ordinaria número 77 del treinta y uno de enero del año 2026 por el Concejo Municipal de Puerto Jiménez. Tome nota el Concejo Municipal de todo lo dispuesto en el Considerando II de esta resolución. Una vez integradas en sede Municipal al presente procedimiento las siguientes personas: el señor Rolando Muñoz Contreras (expediente PU-7159-2014) y la señora Norma Porras Quirós (expediente PU-7302-2015) y transcurrido el plazo concedido en la audiencia respecto al veto planteado en contra de los acuerdos números 12 y 13 adoptados en la Sesión Ordinaria número 77 del treinta y uno de enero del año 2026 por el Concejo Municipal de Puerto Jiménez, deberá el Concejo Municipal resolver a la brevedad el veto interpuesto, enumerando y resolviendo todos y cada uno de los agravios y pretensiones planteadas, así como todos los argumentos de descargo de todos los involucrados.
Cumplidos los puntos aquí ordenado el Concejo Municipal deberá proseguir con el el trámite que en Derecho corresponde. Por la forma en que se resuelve, se omite especial pronunciamiento sobre los agravios planteados en el veto interpuesto. Es todo. Notifíquese.
