This Tribunal, acting as non-hierarchical controller of legality (contralor no jerárquico de legalidad), reviews the Precautionary Measure requested in connection with the Veto filed by Mr. Enrique Segnini Saballo, ID: 5-0248-0033, in his capacity as Municipal Mayor (Alcalde Municipal), against Resolutions numbers 12 and 13 adopted at Ordinary Session (sesión ordinaria) number 77 of January thirty-first, two thousand and twenty-six, by the Municipal Council (Concejo Municipal) of Puerto Jiménez.

CONSIDERANDO
Of relevance to the resolution of this precautionary measure, the following facts are established:
In the present matter, the petitioning party requests the following: "(...) VI. Request for a Precautionary Measure. On the basis of Article 167, paragraph two, of the Código Municipal, which provides that the veto suspends execution of the challenged resolution, as well as Art. 19 of the Código Procesal Contencioso Administrativo, this Tribunal is requested to adopt the following precautionary measures: a) The immediate suspension of all execution, compliance, or material effects of Resolutions numbers 14 and 15 of Ordinary Session number 77 of January 31, 2026. b) The suspension of all eviction or demolition proceedings against Mr. Rolando Muñoz Contreras and his improvements (mejoras). c) The suspension of any act aimed at placing Ms. Norma Porras Quirós in enjoyment of the property that is the subject of the dispute. (...)." (Folios 07 and 08 of the precautionary measure file). It must be noted here that the appellant subsequently clarified which resolutions are the subject of the veto: "(...) It is the duty of this representation to rectify in a direct, loyal, and transparent manner before this Tribunal the following: the vetoed resolutions are indeed numbers twelve (12) and thirteen (13) of Ordinary Session No. 77, held on January thirty-first, two thousand and twenty-six, of the Municipal Council of Puerto Jiménez, and not numbers fourteen (14) and fifteen (15) as had erroneously been stated in previous briefs.
(...)." (Folios 1020 to 1052 of the main case file and folios 63 to 95 of the precautionary measure file); consequently, the request for a precautionary measure is analyzed in light of these resolutions, namely Nos. 12 and 13.
At the time of filing the request for a precautionary measure, the party developed the prerequisites for precautionary measures as follows: regarding the prima facie appearance of legality (apariencia de buen derecho), it stated that the grounds for absolute nullity (nulidad absoluta) set forth—a conflict of interest under Article 236 of the Ley General de la Administración Pública, failure to hold the mandatory hearing required by Article 57 of the Regulations to Ley N° 6043, and violation of due process (debido proceso) under Articles 39 and 41 of the Constitution—demonstrate prima facie the illegality of the challenged resolutions. Regarding the danger in delay (peligro en la demora), it argued that execution of the resolutions would result in the eviction of Mr. Muñoz Contreras and the demolition of his improvements, causing serious, imminent, and irreparable harm that would render any subsequent favorable ruling meaningless. With respect to the balancing of interests (ponderación de intereses), it stated that the dispute involves two private individuals competing over a use permit (permiso de uso) in the Maritime-Terrestrial Zone (Zona Marítimo Terrestre), whose suspension does not cause serious harm to the public interest, whereas its execution would cause irreparable damage to the affected individual.
In this matter, it is important to note that the object of the precautionary measure is the suspension of the vetoed resolutions until this appellate body resolves the present veto. However, such a request is inadmissible as a precautionary measure, since it is not admissible insofar as the mere filing of a veto already operates by law to suspend execution of the vetoed resolution. In that regard, Article 167 of the Código Municipal provides, in the relevant part: "Article 167— The Municipal Mayor may veto municipal resolutions on grounds of legality or expediency, within the fifth business day counted from the day following official communication of the final resolution by the Secretariat of the Municipal Council. The Municipal Mayor shall set forth in the brief to be submitted the reasons supporting the veto and the legal rules or principles violated. The filing of the veto shall suspend execution of the resolution.
At the next session immediately following submission of the veto, the council must reject or accept it. If it is rejected, regardless of the reason, the council shall order the veto to be referred on appeal (en alzada) to the Administrative Court, for it to resolve in accordance with the law." (bold and underlining not in the original); that is, the mere filing of the veto already carries with it, by operation of law, the suspension of execution of the vetoed resolution, until the matter is finally decided by this collegiate body (órgano colegiado). In this regard, the former Sección Tercera of this court stated: "(....) II) ON THE SCOPE OF THE MUNICIPAL VETO AND SUSPENSION OF EXECUTION OF THE RESOLUTION: 'It is necessary to recall that our Constitution, in sub-item 1) of Article 173, establishes an internal check within the essential organizational structure of local government, which, as we recall, is composed of the Municipal Council (as the deliberative body (cuerpo deliberativo)) and the executive officer (funcionario ejecutivo) (Article 169 of the Constitution), who under current legislation is called the "Municipal Mayor," constituting a mechanism proper to the system of checks and balances, in some respects similar to that which governs the Branches of the State.
Thus, pursuant to said Article 173 of the Constitution, the Municipal Mayor is granted the power to exercise the veto against resolutions of the Municipal Council, a power that should be understood more as an objection than as an appeal, given that the latter is rather the proper and exclusive prerogative of private parties. It is therefore an official disapproval, which the law attributes to the Mayor, in his capacity as executive officer and integral member of local government, so that within that government he may exercise opposition to resolutions derived from the collegiate body in which he has not participated—inasmuch as, although he attends sessions of the Municipal Council, he does not have the right to vote (sub-item c) of Article 17 of the Código Municipal)—but which may undoubtedly interfere negatively with his role as "general manager" of the local entity and above all with his governing plan, as required by current legislation itself.'1 Article 158 of the Código Municipal governs the figure of the Veto against Resolutions of the Municipal Council, which may be filed on grounds of legality or expediency.
The Mayor must, within the fifth day after the resolution has been definitively approved, file the veto. Such filing shall immediately suspend execution of the resolution; the foregoing applies regardless of whether or not the veto is rejected, and the suspension of execution shall remain in effect until Sección Tercera of the Administrative Court, acting as the non-hierarchical oversight body (Jerarca Impropio), hears the municipal veto and issues, by way of judgment, the definitive answer to the objection. (...)" That being so, the filing of the veto against Resolutions numbers 12 and 13 adopted at Ordinary Session number 77 of January thirty-first, two thousand and twenty-six, by the Municipal Council of Puerto Jiménez, results in the immediate suspension of execution of the challenged resolutions, pursuant to Article 167 of the Código Municipal. Accordingly, this collegiate body cannot order the Municipal Council to do what the Mayor has requested, since what he seeks as a precautionary measure is the direct and legal consequence of what is provided in the cited article. To put it more simply: the mere filing of the veto provides by law for the immediate suspension of the vetoed act, such that no administrative or judicial act could alter that legal provision or order its execution; this means that this non-hierarchical oversight body cannot, by means of a precautionary measure, order the municipal council body (cuerpo edil) to suspend the effects of the vetoed resolutions, when those acts are already suspended by operation of law.
POR TANTO
For the foregoing considerations of fact and law, the requested precautionary measure is declared inadmissible. That is all. Notify the parties. CONCEJO MUNICIPAL DE PUERTO JIMÉNEZ N° 2026003044 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las quince horas con veintitres minutos del trece de Mayo del dos mil veintiseis.- Conoce este Tribunal como contralor no jerárquico de legalidad, de la Medida Cautelar solicitada dentro del Veto interpuesto por el señor Enrique Segnini Saballo, cédula: 5-0248-0033 en su condición de Alcalde Municipal, en contra de los Acuerdos números 12 y 13 adoptados en la Sesión Ordinaria número 77 del treinta y uno de enero del año 2026 por el Concejo Municipal de Puerto Jiménez.- Redacta la Jueza Solís Valverde y;
CONSIDERANDO
De interés para la resolución de la presente medida cautelar; se tienen por acreditados los siguientes hechos:
En el presente asunto la parte promovente solicita lo siguiente: "(...) VI. Solicitud de medida cautelar Con fundamento en el artículo 167, párrafo segundo, del Código Municipal, que establece que el veto suspende la ejecución del acuerdo impugnado, así como en el artículo 19 del Código Procesal Contencioso Administrativo, se solicita a este Tribunal la adopción de las siguientes medidas cautelares: a) La suspensión inmediata de toda ejecución, cumplimiento o efectos materiales de los acuerdos números 14 y 15 de la sesión ordinaria número 77 del 31 de enero de 2026. b) La suspensión de todo proceso de desalojo o demolición contra el señor Rolando Muñoz Contreras y sus mejoras. c) La suspensión de cualquier acto tendiente a poner a la señora Norma Porras Quirós en disfrute del bien objeto de la controversia. (...).". (Folio 07 y 08 del legajo de medida cautelar). Aquí se debe considerar que la parte recurrente aclara posteriormente, cuales son los acuerdos objeto del veto: "(...) Es deber de esta representación rectificar de manera frontal, leal y transparente ante este Tribunal lo siguiente: efectivamente los acuerdos vetados corresponden a los números doce (12) y trece (13) de la sesión ordinaria N.° 77, celebrada el treinta y uno de enero de dos mil veintiséis, del Concejo Municipal de Puerto Jiménez, y no a los números catorce (14) y quince (15) como erróneamente se había venido indicando en escritos anteriores. (...)." (folios 1020 a 1052 del expediente principal y folios 63 a 95 del legajo de medida cautelar), por lo que la solicitud de medida cautelar se analiza a la luz de estos acuerdos, sean 12 y 13.-
Al momento de presentar la solicitud de medida cautelar desarrolla los presupuestos de las medidas cautelares de la siguiente manera: en cuanto a la apariencia de buen derecho señala que los vicios de nulidad absoluta expuestos -conflicto de interés del artículo 236 de la Ley General de la Administración Pública, omisión de audiencia obligatoria del artículo 57 del Reglamento a la Ley N° 6043, y violación al debido proceso de los artículos 39 y 41 constitucionales- evidencian prima facie la ilegalidad de los acuerdos impugnados. Sobre el peligro en la demora aduce que, la ejecución de los acuerdos implicaría el desalojo del señor Muñoz Contreras y la demolición de sus mejoras, lo que causaría un daño grave, actual e irreparable que haría ilusoria cualquier resolución posterior favorable y respecto a la ponderación de intereses, manifiesta que se trata de una disputa entre dos particulares sobre un permiso de uso en Zona Marítimo Terrestre, cuya suspensión no causa perjuicio grave al interés público, mientras que su ejecución sí causaría daño irreparable al administrado afectado.-
En la especie es importante destacar que el objeto de la medida cautelar es la suspensión de los acuerdos vetados, hasta tanto no se resuelva por parte de esta alzada el presente veto. No obstante dicha gestión resulta improcedente como medida cautelar y es que esta solicitud no es admisible, en el tanto la sola interposición de un veto impone de manera legal la suspensión de la ejecución del acuerdo vetado. En dicho sentido, el numeral 167 del Código Municipal, establece en lo de interés: "Artículo 167- El alcalde municipal podrá interponer el veto a los acuerdos municipales por motivos de legalidad u oportunidad, dentro del quinto día hábil, contado a partir del día siguiente en que el acuerdo firme le sea comunicado oficialmente por la Secretaría del Concejo Municipal. El alcalde municipal indicará en el memorial que presentará las razones que lo fundamentan y las normas o principios jurídicos violados.
La interposición del veto suspenderá la ejecución del acuerdo. En la sesión posterior, inmediata a la presentación del veto, el concejo deberá rechazarlo o acogerlo. Si es rechazado, independientemente del motivo, el concejo ordenará remitir el veto, en alzada ante el Tribunal Contencioso-Administrativo, para que este resuelva conforme a derecho." (la negrita y el subrayo no son del original); es decir, que la sola interposición del veto ya trae aparejado por mandato legal la suspensión de la ejecución del acuerdo vetado, hasta que este sea conocido en última instancia por este órgano colegiado. Al respecto la antigua sección tercera de este despacho, señaló: "(....) II) SOBRE LOS ALCANCES DEL VETO MUNICIPAL Y LA SUSPENSIÓN DE LA EJECUCIÓN DEL ACUERDO: "Resulta necesario recordar que nuestra Ley Fundamental en el inciso 1) del artículo 173, establece un control a lo interno de la organización esencial del gobierno local, que recordemos, se compone por el Concejo Municipal (como cuerpo deliberativo) y por el funcionario ejecutivo (artículo 169 de la Constitución), que en la actual legislación se denomina "Alcalde Municipal", que se estatuye en un mecanismo propio del sistema de pesos y contrapesos, de alguna manera, similar al que rige entre los Poderes del Estado.
Así, conforme al indicado numeral 173 constitucional, se le concede al Alcalde Municipal, la facultad de ejercer el veto contra los acuerdos del Concejo Municipal, opción que debemos entenderlo más como una objeción que como un recurso, en tanto este último, es más bien propio y exclusivo de los administrados. Se trata entonces de una desaprobación oficiosa, que la ley le atribuye al Alcalde, en su carácter de funcionario ejecutivo, parte integrante del gobierno local, para que en el seno del mismo pueda ejercer oposición a los acuerdos que deriven del órgano colegiado, de los cuales no han participado -en tanto no obstante que asiste a las sesiones del Concejo, no tiene derecho al voto -inciso c) del artículo 17 del Código Municipal)-, pero que sin duda pueden interferir negativamente en su labor de "gerente general" de la entidad local y sobre todo en su plan de gobierno, que le exige la misma legislación actual."1 El artículo 158 del Código Municipal regula la figura del Veto contra Acuerdos del Concejo Municipal, el cual podrá ser interpuesto por razones de legalidad u oportunidad.
El Alcalde deberá dentro del quinto día después de aprobado el acuerdo en forma definitiva presentar el veto. Dicha interposición suspenderá de forma inmediata la ejecución de acuerdo, lo anterior independientemente del rechazo o no del mismo, la suspensión de la ejecución del acuerdo se mantendrá hasta que la Sección Tercera del Tribunal Contencioso Administrativo, conozca como Jerarca Impropio el veto municipal, y dicte mediante sentencia la respuesta definitiva a la objeción. (...)" Así las cosas, la interposición del veto en contra de los Acuerdos números 12 y 13 adoptados en la Sesión Ordinaria número 77 del treinta y uno de enero del año 2026 por el Concejo Municipal de Puerto Jiménez, tiene como resultado la suspensión inmediata de la ejecución del acuerdo cuestionado, lo anterior en aplicación del numeral 167 del Código Municipal. En dicho sentido, no puede este órgano colegiado ordenar al Concejo Municipal lo peticionado por el señor Alcalde, siendo que lo que pide como medida cautelar es resultado directo y legal de lo reglado en el numeral de cita. Más sencillo, la sola interposición del veto, dispone por ley la suspensión inmediata del acto vetado, de forma tal que ningún acto administrativo o jurisdiccional podría variar dicha disposición legal, ni ordenar su ejecución, lo que implica que, este Jerarca Impropio no puede, mediante una medida cautelar, ordenar al cuerpo edil la suspensión de los efectos de los acuerdos vetados, cuando dichos actos ya están suspendidos por mandato legal.-
POR TANTO
Por las consideraciones de hecho y derecho indicadas, se declara improcedente la medida cautelar solicitada. Es todo. Notifíquese.
