PODER JUDICIAL TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL JUVENIL Resolution: 2025-2075 Case File: 19-000058-0611-PE (23) TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL JUVENIL. Segundo Circuito Judicial de San José. (Acting in the capacity of the T.A.S.P. of the Segundo Circuito Judicial de San José.) Goicoechea, at nine forty-five in the morning on the tenth of December, two thousand twenty-five.

Appeal of judgment filed in the present case brought against [Nombre 001], Costa Rican citizen, holder of national identity card (cédula de identidad) number [Valor 001], born on December 1, 1954, son of [Nombre 002] and [Nombre 003], for the offense of INVASION OF A PROTECTED AREA AND OTHER CHARGES, to the detriment of NATURAL RESOURCES.

Participating in the decision on the appeal are Judges Flor Sidey Salazar Fallas, Flory Chaves Zárate, and Judge Gustavo A. Jiménez Madrigal.

Licenciado Hugo Navas Vargas appeared before this court in his capacity as private defense attorney for the accused.

FINDINGS:

I.That by means of judgment number 337-2025, issued by the Tribunal Penal del Tercer Circuito Judicial de San José, Sede Suroeste, Pavas, at fifteen hundred hours on the seventh of May, two thousand twenty-five, it was resolved: "Por tanto: In accordance with the foregoing, articles 39 and 41 of the Constitución Política; 59 through 63 and 314 of the Código Pena, and 1, 258, 265, 363, 373 through 375 of the Código Procesal Penal; the application of the ABBREVIATED PROCEDURE (PROCEDIMIENTO ABREVIADO) is approved, and consequently [Nombre 001] is declared the responsible perpetrator of ONE COUNT OF INVASION OF A WILDLIFE CONSERVATION AREA in ideal concurrence (concurso ideal) with one count of ILLEGAL DISPOSAL OF ILLEGALLY DEPOSITED WASTE and ONE COUNT OF USURPATION OF PUBLIC DOMAIN PROPERTY, committed to the detriment of NATURAL RESOURCES, imposing upon him a sentence of FOUR MONTHS' IMPRISONMENT for each offense (minimum sentence reduced by one-third), for a total of EIGHT MONTHS' IMPRISONMENT.

Once the judgment is final, the convicted person shall serve the sentence in the manner and at the location determined by the applicable prison regulations. Since the convicted person does not have a clean criminal record, he is not granted the benefit of a suspended sentence (ejecución condicional de la pena). A final dismissal (sobreseimiento definitivo) is entered on grounds of prescription (prescripción) with respect to the FIVE COUNTS OF CONTEMPT OF AUTHORITY previously attributed to the convicted person. [Nombre 001] is ordered, within a period of three months — counted from the date on which this judgment becomes final — to: 1. Remove all waste (residuos) found at surface level, as well as any waste that has been buried or covered by undergrowth, that was deposited within the 530 square meters of the protection zone of the permanent spring (naciente) located at GPS point 214.040 and 517.333, specifically that deposited on the property in the Partido de San José, registration number (matrícula) [Valor 002], and to lawfully dispose of said waste at a site authorized to receive ordinary solid waste. 2.

Demolish, on the property in the Partido de San José, matrícula [Valor 002], the 70 meters of concrete pipes placed over the channel (cauce) of the unnamed stream (quebrada) that originates from the permanent spring located at GPS point 214.040 and 517.333, remove all waste generated by the works, and lawfully dispose of said waste at a site authorized to receive ordinary solid waste. 3. Immediately cease the discharge of wastewater from any dwelling or structure located within the property into the affected stream. The Municipalidad de Santa Ana is delegated and empowered, in the person of the municipal mayor, WHO MUST BE PERSONALLY NOTIFIED OF THIS RULING, to oversee, in the exercise of its functions, compliance with what is ordered herein. In the event of non-compliance by the convicted person with what is ordered herein, the Municipalidad de Santa Ana is ordered to carry out all necessary acts to restore the affected area to its previous condition, and may charge the convicted person for all expenses incurred in such works.

The civil damages action (acción civil resarcitoria) filed by the Procuraduría General de la República against the civil defendant [Nombre 001] is granted, being upheld for environmental damage (daño ambiental) in the amount of FIVE MILLION NINE HUNDRED SEVENTY-SIX THOUSAND ONE HUNDRED COLONES (5.976.100.00), which shall be paid within eight days following the finality of the judgment, plus statutory interest and indexation (indexación) on said total amount, which shall accrue from the day the judgment becomes final until the moment payment is made. Once this judgment is final, it shall be registered in the Registro Judicial de Delincuencia. Notify the Juzgado de Ejecución de la Pena and the Instituto Nacional de Criminología for the matters within their respective competence. Notify.— Msc. Sonia Quintana Ujueta, Trial Judge.

II.Against the foregoing ruling, licenciado Hugo Navas Vargas, in his capacity as private defense attorney for the accused, filed an appeal of judgment.

III.After completing the corresponding deliberation in accordance with the provisions of article 465 of the Código de Procesal Penal, the Court considered the issues raised in the appeal.

IV. That the relevant legal requirements have been observed throughout the proceedings

The appellate opinion is drafted by appellate Judge Salazar Fallas; and,

CONSIDERING:

I.On the jurisdiction of this Court. Pursuant to the agreement reached by the Consejo Superior at session number 33-2022 of April 21, 2022, article XLIV, as well as by Corte Plena at session number 35-2024 of August 12, 2024, the jurisdiction of this Court of Appeals was expanded to hear applications for extensions of pretrial detention and appeals of judgments falling within the competence of the Tribunal de Apelación de Sentencia Penal of the Segundo Circuito Judicial de San José, effective September 10, 2024. For this reason, the Court has jurisdiction to hear and resolve the appeal filed.

II.Admissibility. Upon review of the record, the appeal filed by licenciado Hugo Navas Vargas against judgment number 377-2025 of the Tribunal Penal del Tercer Circuito Judicial de San José, at fifteen hundred hours on the seventh of May, two thousand twenty-five, was submitted within the applicable time limit and in accordance with the requirements set forth by the applicable rules, satisfying the requirements of subjective and objective specificity (taxatividad subjetiva y objetiva), and is therefore declared admissible for consideration and resolution.

III.First ground of appeal: "Erroneous application of substantive law." In the first ground of appeal, the defense attorney, on behalf of the defendant [Nombre 001], raises the issue of erroneous application of substantive law with respect to the offense of unlawful waste disposal. He argues that the challenged judgment entered a final dismissal in favor of his client for five counts of contempt of authority, which, in his view, constitute the prerequisite for the offense of unlawful waste disposal. He therefore maintains that an acquittal should have been entered in favor of the defendant with respect to that environmental offense. The defendant's representative states that, by means of a brief dated July 4, 2025, based on article 147 of the Código Procesal Penal, he requested amendment and clarification (adición y aclaración) of judgment number 337-2025, issued by the court of first instance at fifteen hundred hours on the seventh of May, two thousand twenty-five, requesting that it be specified which facts constituted the offense of invasion of a wildlife conservation area and which constituted the offense of usurpation of public domain property, in order to be in a position to challenge the judgment without suffering a violation of the right to a defense.

He notes that the court of first instance, by ruling issued at fourteen hours and twenty-six minutes on July 24, 2025, rejected the request for amendment and clarification as procedurally inadmissible. In response to that denial, the defense attorney states that the facts described in points 1) through 14) relate to the orders issued by the Municipalidad de Santa Ana for the defendant to cease receiving earth and rubble on his property, under warning of incurring liability for the offense of contempt of authority. The appeal reproduces the content of the criminal charges as described in points 1) through 14). He further notes that in Considerando III of the judgment, the Tribunal a quo states that, although in points 3 through 14 the defendant is charged with five counts of contempt of authority and such facts are found proven, the criminal action with respect to those offenses is extinguished by prescription, which is why a final dismissal is entered in the defendant's favor for those five offenses.

However, he emphasizes that in the same considerando the trial court holds that the offenses of invasion of a wildlife conservation area, unlawful waste disposal, and usurpation of public domain property are of a permanent nature and therefore not time-barred, proceeding to analyze them on the basis of the complaint filed by the Municipal Mayor of Santa Ana, the closure records, the municipal police observation reports, and the photographic sequence, ultimately finding the defendant the responsible perpetrator of one count of invasion of a wildlife conservation area in ideal concurrence with one count of unlawful waste disposal and one count of usurpation of public domain property, imposing upon him a sentence of four months' imprisonment for each count, for a total of eight months' imprisonment. Regarding this, the defense attorney maintains that the offense of unlawful waste disposal required, for its consummation, non-compliance with the municipal orders warning his client to cease receiving earth and rubble on the property.

He argues that the challenged judgment acknowledges that, with respect to those instances of non-compliance — which it characterizes as acts of contempt — a final dismissal has been entered on grounds of prescription of the criminal action, yet the conviction for unlawful waste disposal is maintained. On this basis, he alleges that, if the criminal action was declared extinguished for the facts that constituted the prerequisite for the environmental offense, it cannot be held that the offense of unlawful waste disposal was consummated, given the absence of the necessary predicate — namely, the warning and the orders whose violation would constitute the prerequisite element of the offense. On the basis of this reasoning, the defendant's representative argues that the judgment erroneously applies the offense of unlawful waste disposal and that, consequently, a final dismissal or an acquittal should have been entered in his client's favor for that offense.

He requests that the appeal be granted, the challenged judgment be annulled, and a new judgment be issued acquitting his client of all penalty and responsibility as perpetrator of the offense of unlawful waste disposal, with the case file subsequently remitted to the court of origin so that, in a new hearing, the appropriate sentence may be determined.

IV.Second ground of appeal: "Objection to the determination of the facts". In the second ground of appeal, defense counsel, acting on behalf of the accused [Nombre 001], raises a grievance related to the determination of the facts, pursuant to Article 459 of the Code of Criminal Procedure. He argues that his client did not commit the offense of unlawful disposal of waste (disposición ilegal de residuos), and therefore, he asserts, it is not appropriate to impose upon him the restorative obligations set forth in the judgment, relating to the removal of waste and the restoration of the affected site to its original condition. Defense counsel argues that [Nombre 001] was never served with a warning ordering him to cease receiving waste, so that, in attributing to him the commission of that offense, the appealed judgment distorts the true facts of what occurred. He notes that the challenged ruling, in the section entitled "V.

On the restoration of things to their original state," states that the convicted person, within the abbreviated procedure (proceso abreviado), committed to restoring things to their prior state pursuant to Article 140 of the Code of Criminal Procedure, and that for this reason the accused is ordered to, within a period of three months from the date the judgment becomes final, proceed to remove all waste — whether surface-level or buried — deposited in 530 square meters of the protection zone (área de protección) of the permanent spring (naciente permanente), located at the GPS point indicated, within the property registered under number [Valor 002], and to lawfully dispose of said waste at a site authorized to receive ordinary refuse. Defense counsel considers that this obligation derives exclusively from the offense of unlawful disposal of waste, the elements of which, he reiterates, are not established due to the absence of the essential element relating to service of the administrative warning, and that therefore no restorative obligation may be imposed on the basis of an offense that, he asserts, his client did not commit. Accordingly, he requests that the ground of appeal be upheld, that the judgment be partially annulled, and that the obligation imposed on his client to carry out the waste removal be struck.

. V.- Third ground of appeal: "Erroneous application of the rules on civil liability". In the third ground of appeal, defense counsel alleges the erroneous application of the rules on civil liability, citing Articles 1045 of the Civil Code, 103, 122, and 125 of the Penal Code of 1941, as well as Articles 37, 70(a), 71(a), and 111 through 118 of the Code of Criminal Procedure. He argues that the appealed judgment orders his client to pay compensation for damages arising from the offense of unlawful disposal of waste, even though, he asserts, his client is not the perpetrator of that offense. Defense counsel states that the challenged ruling, in considerando VI, entitled "On the civil action for damages (acción civil resarcitoria)," upholds the civil action brought by the Procuraduría General de la República and orders the accused [Nombre 001] to pay ¢5.976.100,00, plus interest and indexation, as compensation for environmental damage (daño ambiental).

The appeal reproduces the reasoning of the trial court, which holds that the compensation is ordered because the right of the civil plaintiff (actora civil), her active and passive standing (legitimación activa y pasiva), and the existence and quantification of the damage were all established from the technical reports submitted: official communication SINAC-ACC-OSJ-OF-456-2023, official communications ACC-OSRP-1446-2018 from SINAC of Puriscal, TAA-DT-149-19 from the Tribunal Ambiental Administrativo, and DA-UHTPCOSJ-1348-2020 from MINAE — documents that, according to the judgment, establish impacts within the protection zone of the spring located on the property, including the deposit of rubble (escombros), fill material, and the culverting of the watercourse, yielding an estimated affected area of 1750 m², with a direct-use cost and a social cost that together total the amount fixed as compensation.

Defense counsel argues that this sum is established because the judgment declares his client to be criminally responsible for the offense of invasion of a wildlife conservation area, in ideal concurrence (concurso ideal) with the offense of unlawful disposal of waste and the offense of usurpation of public-domain property. However, he insists that, in accordance with the arguments set forth in the previous grounds of appeal, [Nombre 001] did not commit the offense of unlawful disposal of waste, and that therefore the civil award does not reflect the true facts of what occurred, since it rests on a tripartite criminal basis one component of which, he asserts, is legally untenable with respect to the civil defendant. He therefore argues that the judgment must be annulled so that, in a new trial, the amount of environmental damage may be recalculated, setting aside the offense that, in his view, cannot be attributed to the civil defendant.

In the relief sought, the appellant requests that the appeal be upheld, that the appealed judgment be annulled with respect to the civil claims, and that the case file be remitted to the court of origin for new proceedings to determine anew the amount of damages to be awarded.

VI.The appeal is granted. The appeal must be granted on grounds different from those advanced by the appellant. Upon conducting a comprehensive review of the judgment issued in this criminal case, this Appellate Chamber finds that the reasoning of the conviction presents substantial deficiencies that affect the validity of the ruling and require that it be declared ineffective, as they significantly impinge upon the fundamental rights of the accused. As is directly apparent from the judgment, the trial court judge, after setting out the facts charged by both the Ministerio Público and the Procuraduría General de la República, proceeded in the initial recitals (considerandos) to address preliminary matters concerning the handling of the case as a plea-agreement proceeding under the special abbreviated procedure (procedimiento especial abreviado); she then set out the facts she found to be proven and the evidence submitted for her consideration.

After setting out the facts, in Considerando III, the judge a quo conducted a statute-of-limitations analysis with respect to the facts charged as contempt of authority (described in points 3 through 14 of the indictment filed by the Ministerio Público and the Procuraduría General de la República), and then carried out a summary assessment of the evidence spanning no more than two pages (found at folios 430 to 432 of the case file), from which she concluded that the charges brought against defendant (encartado) [Nombre 001] could be considered fully proven. Although that assessment might have sufficed to establish the existence of the charged facts, several of which were time-barred and with respect to which the trial court judge had ordered a definitive dismissal (sobreseimiento definitivo), the appealed judgment concludes that such facts constitute the offense of invasion of a wildlife conservation area, the offense of illegal disposal of waste, and the offense of unlawful seizure of public domain property, on the basis that, being continuing offenses, they were not time-barred.

However, the court a quo conducted no legal analysis whatsoever of the objective and subjective elements of the offense (tipicidad objetiva y subjetiva) of those criminal acts, nor did she set out the reasoning by which the proven facts (hechos demostrados) were subsumed within the criminal offenses (tipos penales) established in Art. 58(a) of the Ley Forestal N.° 7575, Art. 61 of the Law on Comprehensive Waste Management (Ley para la Gestión Integral de Residuos, Ley N.° 8839), and Art. 227(1) of the Criminal Code (Código Penal), and she likewise failed to justify the joinder of offenses she referenced or the sentence imposed. In that context, the trial court judge confined herself to stating the following in the appealed judgment:

"Within this framework, there is no alternative but to conclude that the evidence incriminating the defendant is conclusive and highly illuminating, permitting a finding of certainty as to the existence of the offenses attributed to him, which conform in their entirety to the provisions of Art. 58(1) of the Ley Forestal; Art. 61 of the Law on Comprehensive Waste Management; and Art. 227(1) of the Código Penal—criminal acts carried out by the accused without any justification whatsoever, such that they constitute unlawful conduct, criminal wrongs of which he is the sole culpable perpetrator, given that no circumstance of excuse has been established, nor has it been found that he lacked knowledge or understanding of the consequences of his unlawful conduct, notwithstanding which he was not deterred by that understanding, a perspective from which the judgment of reproach against him arises.

The evidence described and analyzed above in this recital makes it possible to prove beyond a reasonable doubt that [Nombre 001] was the person who committed the offenses attributed to him by the Ministerio Público, constituting, as set forth, acts that satisfy the offense elements, are unlawful, and are culpable. Accordingly, [Nombre 001] is hereby declared the culpable perpetrator of ONE OFFENSE OF INVASION OF A WILDLIFE CONSERVATION AREA in ideal concurrence (concurso ideal) with ONE OFFENSE OF ILLEGAL DISPOSAL OF WASTE AND ONE OFFENSE OF UNLAWFUL SEIZURE OF PUBLIC DOMAIN PROPERTY, committed to the detriment of NATURAL RESOURCES, and is sentenced to FOUR MONTHS OF IMPRISONMENT for each offense (the minimum sentence reduced by one-third), for a total of EIGHT MONTHS OF IMPRISONMENT." Notwithstanding, that statement, which appears to be a conclusion, contains no analytical development subsuming the facts within the referenced criminal offenses, nor does it compare the objective and subjective elements of each offense against the proven facts.

This absence of grounds (fundamentación) makes it impossible to understand the reasoning that, in the view of the judge a quo, justifies the assertion that the proven facts constitute the offenses in question, in breach of the constitutional and statutory obligation to provide a reasoned basis for the judgment. That omission is particularly evident when one considers that Art. 58(a) of the Ley Forestal requires, for the offense of invasion of a conservation or protected area to be established, proof of intentional conduct consisting of occupation, possession, or appropriation of a conservation or protected area or other areas of forest or land subject to the forestry regime; that Art. 61 of the Law on Comprehensive Waste Management distinguishes among different types of waste and requires a detailed analysis of the mode of commission (abandonment, deposit, or dumping), of the lawful or unlawful character of the action, and of the status of "water resource protection area, among others" as an aggravating circumstance; and that Art. 227(1) of the Criminal Code requires establishing the wrongful possession of land or space corresponding to streets, roads, gardens, parks, promenades, or other places in the public domain, or to vacant lots or any other property of the State or of municipal governments, without title or right to possess.

None of these elements was addressed by the judge or linked to the proven facts, despite the necessary correspondence between the factual account (relato fáctico) and conformity with the offense elements (configuración típica) required to support a criminal conviction.

The mere assertion that "the evidence is conclusive" does not meet the constitutional standard of reasoned justification; on the contrary, it constitutes a dogmatic statement that disregards the requirements of Art. 142 of the Code of Criminal Procedure (Código Procesal Penal), which expressly prohibits supplying grounds through routine formulas, general descriptions, or summary mentions of the evidence. The appealed judgment does not permit an understanding of which facts are relevant to each criminal offense, why they satisfy the offense elements, how unlawfulness (antijuridicidad) is determined, or whether the requisite subjective element is present for each act. Thus, even though the accused may have admitted the facts as charged, that did not relieve the judge of the duty to conduct a careful and thorough analysis of the offense elements of the conduct. The admission of facts, characteristic of the special abbreviated procedure, does not bind the judge in determining the legal characterization (calificación jurídica) of the offense, nor does it release her from the duty to provide grounds for conformity with the offense elements (adecuación típica).

Such an examination was indispensable for understanding the legal reasoning underlying the conviction, and its absence from the appealed judgment prevents this Chamber from exercising effective oversight of the legality and satisfaction of offense elements of the decision reached, as the appellant has demanded.

On the basis of the foregoing, this Appellate Chamber, in light of Arts. 142, 184, and 363 of the Code of Criminal Procedure, concludes that the appealed judgment is tainted by the defect (vicio) of absence of legal grounds, which is absent from every section of the ruling and directly affects the validity of the judgment. The duty to provide reasoned justification—encompassing factual, evidentiary, legal, and sentencing grounds—remains fully intact even in the abbreviated procedure, as the Sala Constitucional has reiterated in voto 2003-02130 of thirteen hours and forty minutes on the fourteenth of March of two thousand and three, in which it stated, "…[the Court] has been consistent in its jurisprudence in holding that there effectively exists an obligation to provide a clear and sufficient statement of grounds for a judgment resulting from an abbreviated proceeding, and that this forms part of the due process to which the respondent is entitled.

(sentencias 2000-00425 of fifteen hours and fifty-four minutes on the twelfth of January of two thousand and 2001-01737 of fifteen hours and twenty-one minutes on the twenty-eighth of February of two thousand and one)." The Code of Criminal Procedure does not provide that the application of the special abbreviated procedure limits, conditions, or excludes the judge's duty to provide full grounds for the decision. The negotiation between the parties does not imply any waiver on the part of the judge of the jurisdictional function of legally evaluating the facts, nor does it necessarily determine the ruling on the legal characterization. In this case, as has been demonstrated, the legal evaluation is nonexistent, since it offers no clear, pertinent, or verifiable reasons permitting a conclusion as to why the factual basis (plataforma fáctica) charged and found to be proven is subsumable within the criminal offenses for which [Nombre 001] was convicted.

Accordingly, it is appropriate to declare the ruling null and void and to order the remand (reenvío) of the case file to the court of origin, so that, with a different panel composition, it may proceed to conduct the legal and evidentiary evaluation required by law and resolve, with adequate grounds, all matters submitted for its determination. It is appropriate to advise the court that will hear the case on remand that the decision to uphold the present claim, based exclusively on the defect of absence of legal grounds—which entails the partial nullity of the judgment with respect to the conviction of the accused herein—does not constitute any ruling on the merits of the matter. Since no appeal was filed by the prosecution, the definitive dismissal ordered by the trial court for the contempt offenses charged against the defendant, as described in the judgment with respect to facts 3 through 14 of the charging instrument, remains undisturbed.

The ruling of this Chamber must not influence the decisional disposition of the trial court, as it is the responsibility of the judges to evaluate the evidence presented with independence and objectivity and to apply the applicable substantive law, in order to determine, with full objectivity and in accordance with the law, the legal characterization they deem appropriate for the facts brought before them. In light of the manner in which this matter has been resolved—partial nullity of the judgment having been declared and remand for new proceedings having been ordered with respect to the offenses for which the accused herein was convicted—it is not appropriate for this Appellate Court to address the remaining grounds of appeal or the other grievances raised.

Por tanto:

The appeal filed by counsel for the accused [Nombre 001] is hereby granted, and, accordingly, partial ineffectiveness of the appealed judgment is declared, solely with respect to the conviction of defendant [Nombre 001]. Since no appeal was filed by the prosecution, the definitive dismissal ordered by the trial court for the contempt offenses charged against the defendant, as described in the judgment with respect to facts 3 through 14 of the charging instrument, remains undisturbed. The remand of the case file to the court of origin is hereby ordered, so that, with a different panel composition, it may proceed to conduct the legal and evidentiary evaluation required by law and resolve, with adequate grounds, all matters submitted for its determination. Given the nullity declared and the remand ordered, the remaining grounds of appeal and other grievances raised are not addressed. Serve notice.

PODER JUDICIAL TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL JUVENIL Resolución: 2025-2075 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL JUVENIL. Segundo Circuito Judicial de San José. (En funciones del T.A.S.P. del Segundo Circuito Judicial de San José) Goicoechea, a las nueve horas cuarenta y cinco minutos del diez de diciembre de dos mil veinticinco.

Recurso de apelación de sentencia interpuesto en la presente causa seguida contra [Nombre 001], ciudadano costarricense, titular de la cédula de identidad número [Valor 001], nacido el 01 de diciembre de 1954, hijo de [Nombre 002] y de [Nombre 003], por el delito de INVASIÓN A UN ÁREA DE PROTECCIÓN Y OTROS, en perjuicio de LOS RECURSOS NATURALES.

Intervienen en la decisión del recurso las Juezas Flor Sidey Salazar Fallas, Flory Chaves Zárate y el juez Gustavo A. Jiménez Madrigal.

Se apersonó en esta sede el licenciado Hugo Navas Vargas, en su condición de defensor particular del señor acusado.

RESULTANDO:

I.Que mediante sentencia número 337-2025 dictada por el Tribunal Penal del Tercer Circuito Judicial de San José, Sede Suroeste, Pavas, a las quince horas del siete de mayo de dos mil veinticinco, se resolvió: “POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política; 59 a 63 y 314 del Código Pena y 1, 258, 265, 363, 373 a 375 del Código Procesal Penal; se aprueba la aplicación del PROCEDIMIENTO ABREVIADO y en consecuencia se declara a [Nombre 001], autor responsable de UN DELITO DE INVASIÓN A UN ÁREA DE CONSERVACIÓN DE VIDA SILVESTRE en concurso ideal con un delito de DISPOSICIÓN ILEGAL DE DEPÓSITO ILEGAL DE RESIDUOS y UN DELITO DE USURPACIÓN DE BIENES DE DOMINIO PÚBLICO, cometidos en perjuicio de LOS RECURSOS NATURALES imponiéndosele una pena de CUATRO MESES DE PRISIÓN por cada uno de ellos (pena mínima menos el tercio) para un total de OCHO MESES DE PRISIÓN.

La pena establecida deberá descontarla el sentenciado, una vez firme el fallo, en el lugar y forma que determinen los respectivos reglamentos penitenciarios. Al no ser el sentenciado de limpios antecedente penales, no se le otorga el beneficio de ejecución condicional de la pena. Se dicta una sentencia de SOBRESEIMIENTO DEFINITIVO por prescripción, con respecto a los CINCO DELITOS DE DESOBEDIENCIA A LA AUTORIDAD que se le venían atribuyendo al sentenciado. se le ordena a [Nombre 001], que dentro del plazo de tres meses -contados a partir de la firmeza de esta sentencia-, deberá: 1. Remover la totalidad de los residuos que se encuentren a nivel superficial, como aquellos que hayan sido enterrados o cubiertos por la maleza, que fueron depositados en los 530 metros cuadrados del área de protección de la naciente permanente localizada en el punto GPS 214.040 y 517.333, propiamente los que fueron depositados en el fundo del partido de San José, matrícula [Valor 002] y disponer lícitamente de los mismos, en un sitio autorizado para recibir desechos ordinarios. 2.

Demoler en la finca del Partido de San José, matrícula [Valor 002], los 70 metros de tubos de concreto colocados sobre el cauce de la quebrada sin nombre, que se origina de la naciente permanente localizada en el punto GPS 214.040 y 517.333, remover la totalidad de residuos que genere con la obras y disponer lícitamente de los mismos en un sitio autorizado para recibir desechos ordinarios. 3. Cesar de forma inmediata, el arrojo de aguas residuales que genere cualquier vivienda o estructura ubicada dentro de la propiedad en la quebrada afectada. Se delega y se faculta a la Municipalidad de Santa Ana, en la persona del alcalde municipal, A QUIEN DEBERÁ NOTIFICÁRSELE ESTA RESOLUCIÓN DE FORMA PERSONAL, velar para que en el ejercicio de sus funciones, se haga cumplir lo aquí ordenado. En caso de incumplimiento por parte del sentenciado, de lo aquí ordenado, se ordena a la Municipalidad de Santa Ana, realizar todos los actos necesarios, para que la zona afectada se restablezca a su estado anterior, pudiendo cobrar al sentenciado, la totalidad de gastos en que se incurra por esas obras.

Se declara con lugar la acción civil resarcitoria incoada por la Procuraduría General de la República en contra del demandado civil [Nombre 001], acogiéndose la misma por daño ambiental por la suma de CINCO MILLONES NOVECIENTOS SETENTA Y SEIS MIL CIEN COLONES (5.976.100.00), que deberán cancelarse dentro de los ocho días siguientes a la firmeza de la sentencia, más los intereses de ley e indexación sobre dicha suma total, los cuales correrán desde el día en que la sentencia quede firme, hasta el momento en que se haga efectivo el pago. Una vez firme esta sentencia, inscríbase en el Registro Judicial de Delincuencia. Comuníquese al Juzgado de Ejecución de la Pena y al Instituto Nacional de Criminología para lo de sus cargos. Notifíquese.- Msc. Sonia Quintana Ujueta Jueza de Juicio.

II.En contra del anterior pronunciamiento presentó recurso de apelación el licenciado Hugo Navas Vargas, en su condición de defensor particular del señor acusado.

III.Verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta la Jueza de apelación Salazar Fallas; y,

CONSIDERANDO:

I.Sobre la competencia de este Tribunal. Conforme lo acordado por el Consejo Superior en la sesión número 33-2022 del 21 de abril de 2022 artículo XLIV, así como por Corte Plena en la sesión número 35-2024 del 12 de agosto de 2024, se amplió la competencia de este Tribunal de Apelación para el conocimiento de las gestiones de prórroga de prisión preventiva y recursos de apelación de sentencia que sean competencia del Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José a partir del 10 de setiembre de 2024. Por la razón indicada se cuenta con la competencia para entrar en el conocimiento y resolución del recurso planteado.

II.Admisibilidad. Revisados los autos, el recurso de apelación formulado por el licenciado Hugo Navas Vargas, contra la sentencia número 377-2025 del Tribunal Penal del Tercer Circuito Judicial de San José, de las quince horas del siete de mayo del dos mil veinticinco, fue presentado dentro del plazo y de acuerdo con los requisitos dispuestos por las normas aplicables, cumpliendo con los requisitos de taxatividad subjetiva y objetiva, por lo que se declara admisible para su conocimiento y resolución.

III.Primer motivo de apelación: “Errónea aplicación de la ley sustantiva.” En el primer motivo de apelación, el señor defensor, en representación del encartado [Nombre 001], plantea errónea aplicación de la ley sustantiva respecto del delito de disposición ilegal de residuos. Expone que el fallo impugnado dictó sobreseimiento definitivo a favor de su representado por cinco delitos de desobediencia a la autoridad, los cuales, a su criterio, constituyen el presupuesto del delito de disposición ilegal de residuos. Por ello, sostiene que se imponía dictar sentencia absolutoria a favor del imputado en relación con ese ilícito ambiental. El representante del sentenciado indica que, mediante escrito de fecha 4 de julio de 2025, con fundamento en el artículo 147 del Código Procesal Penal, solicitó adición y aclaración de la sentencia número 337-2025, dictada por el Tribunal de instancia a las quince horas del siete de mayo de dos mil veinticinco, requiriendo que se precisara cuáles hechos configuraban el delito de invasión a un área de conservación de vida silvestre y cuáles el delito de usurpación de bienes de dominio público, a fin de quedar en condiciones de impugnar el fallo y no sufrir indefensión.

Señala que el Tribunal de primera instancia, mediante resolución de las catorce horas con veintiséis minutos del 24 de julio de 2025, rechazó la gestión de adición y aclaración por considerarla improcedente. Ante esa negativa, el señor defensor refiere que los hechos del 1) al 14) se vinculan con las órdenes emitidas por la Municipalidad de Santa Ana para que el imputado cesara la recepción de tierra y escombros en su finca, bajo la advertencia de incurrir en el delito de desobediencia a la autoridad. El recurso reproduce el contenido de la acusación fiscal en cuanto a lo descrito del punto 1) al 14). Agrega que en el considerando III del fallo, en el que el Tribunal a quo indica que, aunque en los puntos 3 a 14 se atribuyen al encausado cinco delitos de desobediencia a la autoridad y tales hechos se tienen por demostrados, la acción penal respecto de esos ilícitos se encuentra extinguida por prescripción, razón por la cual se dicta sobreseimiento definitivo en favor del imputado por esos cinco delitos.

Sin embargo, destaca que en el mismo considerando el órgano de juicio sostiene que los delitos de invasión a un área de conservación de vida silvestre, disposición ilegal de residuos y usurpación de bienes de dominio público son de efectos permanentes y, por ende, no prescritos, procediendo a analizarlos con base en la denuncia del Alcalde Municipal de Santa Ana, las actas de clausura, las actas de observación de la Policía Municipal y la secuencia fotográfica, para finalmente declarar a su defendido autor responsable de un delito de invasión a un área de conservación de vida silvestre en concurso ideal con un delito de disposición ilegal de residuos y un delito de usurpación de bienes de dominio público, imponiéndole una pena de cuatro meses de prisión por cada uno, para un total de ocho meses de prisión. Sobre ello, el señor defensor sostiene que el delito de disposición ilegal de residuos requería, para su consumación, el incumplimiento de las órdenes municipales que prevenían a su defendido suspender la recepción de tierra y escombros en la propiedad.

Afirma que la sentencia recurrida reconoce que, respecto de esos incumplimientos, que califica como desobediencias, se ha dictado sobreseimiento definitivo por prescripción de la acción penal, pese a lo cual se mantiene la condena por disposición ilegal de residuos. A partir de ello, alega que, si se declaró extinguida la acción penal por los hechos que constituían el presupuesto del delito ambiental, no puede afirmarse consumado el delito de disposición ilegal de residuos, por faltar el sustento necesario de la advertencia y de las órdenes cuya desobediencia sería el presupuesto del tipo. Con base en este razonamiento, el representante del encartado afirma que el fallo aplica erróneamente el delito de disposición ilegal de residuos y que, en consecuencia, debió dictarse a favor de su representado un sobreseimiento definitivo o una sentencia absolutoria por ese ilícito. Solicita que se declare con lugar el recurso de apelación, se anule la sentencia recurrida y se dicte otra que absuelva de toda pena y responsabilidad a su defendido como autor del delito de disposición ilegal de residuos, remitiéndose posteriormente el expediente al Tribunal de origen para que, en un nuevo debate, proceda a fijar la pena que corresponda.

IV.Segundo motivo de apelación: “Inconformidad con la determinación de los hechos”. En el segundo motivo de apelación, el señor defensor, actuando en representación del encartado [Nombre 001], plantea un agravio vinculado con la determinación de los hechos, al amparo del artículo 459 del Código Procesal Penal. Sostiene que su representado no cometió el delito de disposición ilegal de residuos, por lo que, afirma, no corresponde que asuma las obligaciones restitutorias impuestas en sentencia, relativas a la remoción de residuos y la restitución del sitio afectado a su estado original. El representante del sentenciado argumenta que [Nombre 001] nunca fue notificado de una advertencia que le ordenara omitir la recepción de residuos, de modo que, al atribuirle la comisión de ese delito, la sentencia apelada altera la verdad real de lo sucedido. Señala que el fallo impugnado, en el apartado denominado “V.

Sobre la restitución de las cosas a su estado original”, indica que el sentenciado, dentro del proceso abreviado, se comprometió a restituir las cosas a su estado anterior conforme al artículo 140 del Código Procesal Penal, razón por la cual se ordena al imputado que, dentro de un plazo de tres meses a partir de la firmeza de la sentencia, proceda a remover la totalidad de los residuos, superficiales o enterrados, depositados en 530 metros cuadrados del área de protección de la naciente permanente, ubicada según el punto GPS indicado, dentro del fundo inscrito bajo la matrícula [Valor 002], y disponer de ellos lícitamente en un sitio autorizado para recibir desechos ordinarios. El señor defensor considera que esa obligación deriva exclusivamente del delito de disposición ilegal de residuos, cuya configuración, reitera, no se acredita por faltar el elemento esencial relativo a la notificación de la advertencia administrativa, de modo que no puede imponerse restitución alguna basada en un delito que, afirma, su representado no cometió. En consecuencia, solicita que se declare con lugar el motivo, se anule parcialmente la sentencia y se elimine el deber impuesto a su defendido de realizar la remoción de residuos.

. V.- Tercer motivo de apelación: “Errónea aplicación de las normas sobre responsabilidad civil”. En el tercer motivo de apelación, el señor defensor alega la errónea aplicación de las normas sobre responsabilidad civil, citando los numerales 1045 del Código Civil, 103, 122 y 125 del Código Penal de 1941, así como los artículos 37, 70 inciso a), 71 inciso a) y 111 a 118 del Código Procesal Penal. Sostiene que la sentencia apelada condena a su representado a indemnizar daños derivados del delito de disposición ilegal de residuos, aun cuando, afirma, no es autor de ese ilícito. El representante del encartado expone que el fallo recurrido, en el considerando VI denominado “Sobre la acción civil resarcitoria”, declara con lugar la acción civil interpuesta por la Procuraduría General de la República y condena a al encartado [Nombre 001] al pago de ¢5.976.100,00, más intereses e indexación, por concepto de daño ambiental.

El recurso reproduce la fundamentación del Tribunal de instancia, que sostiene que la indemnización se impone porque se acreditó el derecho de la actora civil, su legitimación activa y pasiva, así como la existencia y cuantificación del daño a partir de los informes técnicos aportados: el oficio SINAC-ACC-OSJ-OF-456-2023, los oficios ACC-OSRP-1446-2018 del SINAC de Puriscal, TAA-DT-149-19 del Tribunal Ambiental Administrativo y DA-UHTPCOSJ-1348-2020 del MINAE, documentos, que conforme al fallo, determinan afectaciones en el área de protección de la naciente existente en el inmueble, incluyendo depósito de escombros, rellenos y entubamiento del cauce, que derivan un área afectada estimada en 1750 m², con un costo de uso directo y un costo social que suman la cantidad total fijada como indemnización. El señor defensor sostiene que ese monto se establece porque la sentencia declara a su representado autor responsable de un delito de invasión a un área de conservación de vida silvestre, en concurso ideal con un delito de disposición ilegal de residuos, y un delito de usurpación de bienes de dominio público.

No obstante, insiste en que, conforme a los argumentos expuestos en los motivos anteriores, [Nombre 001] no cometió el delito de disposición ilegal de residuos, de modo que la condena civil no responde a la verdad real de lo sucedido, pues se sustenta en una tríada delictiva cuya base, según afirma, es jurídicamente insostenible respecto de uno de sus componentes. Por ello, sostiene que el fallo debe ser anulado para que, en un nuevo debate, se redimensione el monto del daño ambiental, prescindiendo del delito que, a su juicio, no puede atribuírsele al demandado civil. En la pretensión recursiva, el impugnante solicita que se declare con lugar el recurso de apelación, se anule la sentencia recurrida en materia civil y se remita el expediente al Tribunal de origen para una nueva sustanciación que permita determinar nuevamente el monto del daño a resarcir.

VI.Se declara con lugar el recurso de apelación. El recurso de apelación debe declararse con lugar por razones diferente a las expuestas por el recurrente. Efectuada la revisión integral de la sentencia dictada en esta causa penal, advierte esta Cámara de Apelación que la motivación de la sentencia condenatoria presenta deficiencias sustanciales que afectan la validez de la resolución y obligan a declarar su ineficacia, en tanto inciden sensiblemente en los derechos fundamentales del imputado. Según se constata directamente del fallo, la juzgadora de instancia, luego de exponer los hechos acusados tanto por el Ministerio Público como por la Procuraduría General de la República, procede en los considerandos iniciales a desarrollar aspectos preliminares referidos a la tramitación del asunto como proceso de composición bajo el procedimiento especial abreviado; seguidamente, enuncia los hechos que tuvo por demostrados y los medios de prueba presentados a su conocimiento.

Una vez expuestos los hechos, en el considerando III, la jueza a quo realiza un análisis de prescripción respecto de los hechos acusados como desobediencia a la autoridad (descritos del punto 3 al 14 de la acusación del Ministerio Público y la Procuraduría General de la República) para luego efectuar una valoración probatoria sumaria que no supera dos páginas (visible de folio 430 a 432 del expediente), sobre la cual concluye que puede tenerse por plenamente demostrada la imputación formulada contra el encartado [Nombre 001]. A pesar de que dicha valoración podría resultar suficiente para determinar la existencia de los hechos acusados, varios de los cuales se encontraban prescritos y respecto de los cuales la juzgadora de instancia dispuso el sobreseimiento definitivo, en la sentencia recurrida se concluye que tales hechos configuran un delito de invasión a un área de conservación de vida silvestre, un delito de disposición ilegal de residuos y un delito de usurpación de bienes de dominio público, afirmando que, por tratarse de figuras de efectos permanentes, no se encontraban prescritas.

Sin embargo, la a quo no realiza análisis jurídico alguno sobre los elementos de tipicidad objetiva y subjetiva de dichos ilícitos, ni expone el razonamiento que permitió subsumir los hechos demostrados dentro de los tipos penales del artículo 58 inciso a) de la Ley Forestal N.° 7575, del artículo 61 de la Ley para la Gestión Integral de Residuos (Ley N.° 8839) y del artículo 227 inciso

  • 1)del Código Penal, así como tampoco justifica el concurso de delitos que menciona, ni la pena impuesta. En ese contexto, la jueza de instancia se limita a afirmar en la sentencia apelada: “Dentro de esta tesitura no queda alternativa más que concluir que la prueba que incrimina al encartado es contundente y altamente esclarecedora, permitiendo arribar a un juicio de certeza en cuanto a la existencia de los delitos que se le endilgan, mismos que se adecuan en un todo a las previsiones de los artículo 58 inciso
  • 1)de la Ley Forestal; 61 de la Ley para la gestión integral de residuos y 227 inciso
  • 1)del Código Penal, conductas delictivas que ejecutó la justiciable sin contar con causa alguna de justificación, de manera que se trata de conductas antijurídicas, injustos penales de los cuales es su único y culpable autor responsable, en virtud que no se ha determinado que existiera tampoco circunstancia alguna de exculpación o que no conociera y entendiera las consecuencias de su ilícito actuar, a pesar de lo cual no se motivó con dicha comprensión, perspectiva desde la cual emerge en su contra el juicio de reproche. La prueba supra descrita y analizada en este considerando, permite demostrar más allá de toda duda razonable que [Nombre 001] fue la persona que incurrió en los delitos que el Ministerio Público le ha venido atribuyendo, constituyendo éstas acciones típicas, antijurídicas y culpables, conforme se ha expuesto. En consecuencia, se declara a [Nombre 001], autor responsable de UN DELITO DE INVASIÓN A UN ÁREA DE CONSERVACIÓN DE VIDA SILVESTRE en concurso ideal con un delito de DISPOSICIÓN ILEGAL DE RESIDUOS y UN DELITO DE USURPACIÓN DE BIENES DE DOMINIO PÚBLICO, cometidos en perjuicio de LOS RECURSOS NATURALES imponiéndosele una pena de CUATRO MESES DE PRISIÓN por cada uno de ellos (pena mínima menos el tercio) para un total de OCHO MESES DE PRISIÓN.” No obstante, esa afirmación, que parece una conclusión, no contiene un desarrollo analítico que subsuma los hechos en los tipos penales referidos, ni contrasta los elementos objetivos y subjetivos de cada figura penal con los hechos probados. Esta ausencia de fundamentación impide conocer el razonamiento que, según la jueza a quo, justifica la afirmación de que los hechos demostrados constituyen los delitos mencionados, incumpliendo con la obligación constitucional y legal de motivar la sentencia. Dicha omisión resulta especialmente evidente si se considera que el artículo 58 inciso a) de la Ley Forestal exige para la configuración del delito de invasión a un área de conservación o protección, que se verifique una conducta dolosa de ocupación, detentación o apropiación sobre un área de conservación o protección u otras áreas de bosques o terrenos sometidos al régimen forestal; que el artículo 61 de la Ley para la Gestión Integral de Residuos distingue entre diferentes tipos de residuos y exige un análisis detallado de la modalidad comisiva (abandono, depósito o arrojo), del carácter legal o ilegal de la acción y de la condición de “área de protección del recurso hídrico, entre otros” como circunstancia agravante; y que el artículo 227 inciso
  • 1)del Código Penal requiere acreditar la detentación indebida de suelo o espacio correspondiente a calles, caminos, jardines, parques, paseos u otros lugares de dominio público, o terrenos baldíos o cualquier otra propiedad del Estado o de las Municipalidades, sin título ni derecho de poseer. Ninguno de estos extremos es abordado ni vinculado por la juzgadora con los hechos demostrados, pese a la necesaria correspondencia entre el relato fáctico y la configuración típica, para sustentar la condena penal. El simple señalamiento de que “la prueba es contundente” no satisface el estándar constitucional de motivación; por el contrario, constituye una afirmación dogmática que desconoce las exigencias del artículo 142 del Código Procesal Penal, que expresamente prohíbe suplir la fundamentación mediante fórmulas rutinarias, descripciones generales o menciones sumarias de la prueba. La sentencia apelada no permite comprender cuáles hechos son relevantes para cada tipo penal, por qué son típicos, cómo se determina la antijuridicidad y si concurre el elemento subjetivo requerido para cada conducta. De modo que, aunque el imputado hubiese aceptado los hechos tal como fueron acusados, ello no eximía a la persona juzgadora de realizar un análisis cuidadoso y completo sobre los elementos de tipicidad del hecho. La aceptación de hechos, propia del procedimiento especial abreviado, no vincula a la jueza en la determinación de la calificación jurídica ni la libera del deber de fundamentar la adecuación típica. Tal examen era indispensable para conocer el razonamiento jurídico que sustentaba la condena y, al faltar en el fallo apelado, se impide a esta Cámara ejercer un control efectivo de legalidad y tipicidad respecto de la decisión adoptada, como lo ha requerido el recurrente. Con base en lo anterior, esta Cámara de Apelaciones, a la luz de los artículos 142, 184 y 363 del Código Procesal Penal, concluye que la sentencia apelada incurre en vicio de falta de fundamentación jurídica, la cual no se deriva de ningún apartado de la resolución y afecta directamente la validez del fallo. El deber de motivación, que comprende la fundamentación fáctica, probatoria, jurídica y de la sanción, se mantiene incólume incluso en el procedimiento abreviado, como lo ha reiterado la Sala Constitucional en el voto 2003-02130 de las trece horas con cuarenta minutos del catorce de marzo de dos mil tres, en el que indicó, “…ha sido constante en su jurisprudencia, para señalar que, efectivamente existe una obligación de fundamentar de forma clara y suficiente la sentencia que resulta de un proceso abreviado y que ello es parte del debido proceso a que tiene derecho el demandado. (sentencias 2000-00425 de las quince horas cincuenta y cuatro minutos del doce de enero del dos mil y 2001-01737 de las quince horas veintiún minutos del veintiocho de febrero de dos mil uno).” El Código Procesal Penal no dispone que la aplicación del procedimiento abreviado limite, condicione o excluya el deber del juzgador de fundamentar plenamente la decisión. La negociación entre partes no implica renuncia por parte de la persona juzgadora a la función jurisdiccional de valorar jurídicamente los hechos ni determina, necesariamente, la resolución sobre la calificación legal. En este caso, como ha sido evidenciado, la valoración jurídica es inexistente, pues no ofrece razones claras, pertinentes o verificables que permitan concluir por qué la plataforma fáctica imputada y que se tuvo por demostrada, es subsumible en los tipos penales por los cuales se condenó a [Nombre 001]. En consecuencia, corresponde declarar la nulidad de la resolución y ordenar el reenvío del expediente al Tribunal de origen, para que, con diferente integración, proceda a efectuar la valoración jurídica y probatoria que en Derecho corresponda, y resuelva de manera debidamente fundada todos los extremos sometidos a su conocimiento. Conviene advertir al tribunal que conocerá el juicio de reenvío que la decisión de acoger el presente reclamo, fundada exclusivamente en el vicio de falta de fundamentación jurídica que conlleva la nulidad parcial de la sentencia, en cuanto a la condenatoria del aquí imputado, lo que no implica pronunciamiento alguno sobre el fondo del asunto. Por no haberse recurrido por el órgano fiscal, queda incólume el sobreseimiento definitivo ordenado por el tribunal de instancia, por los delitos de desobediencia acusados contra el encartado, descritos según lo establecido en el fallo, del hecho 3 a 14 de la pieza acusatoria. Lo resuelto por esta Cámara no debe incidir en el ánimo decisorio del tribunal de juicio, pues corresponde a las personas juzgadoras valorar con independencia y objetividad la prueba que se rinda y aplicar la normativa sustantiva que resulte pertinente, a fin de determinar, con plena objetividad y conforme a Derecho, la calificación jurídica que en su criterio corresponda a los hechos sometidos a su conocimiento. En virtud de la forma en que se resuelve, al declararse la nulidad parcial de la sentencia y ordenarse el reenvío para una nueva sustanciación, por los delitos que fue condenado el aquí imputado, no resulta procedente que este Tribunal de Apelación entre a resolver los restantes motivos de apelación ni los demás agravios planteados.

POR TANTO:

Se declara con lugar el recurso de apelación formulado por la defensa técnica del imputado [Nombre 001] y, en consecuencia, la ineficacia parcial de la sentencia recurrida, únicamente en cuanto a la condenatoria del encartado [Nombre 001]. Por no haberse recurrido por el órgano fiscal, queda incólume el sobreseimiento definitivo ordenado por el tribunal de instancia, por los delitos de desobediencia acusados contra el encartado, descritos según lo establecido en el fallo, del hecho 3 a 14 de la pieza acusatoria. Se ordena el reenvío del expediente al Tribunal de origen para que, con diferente integración, proceda a efectuar la valoración jurídica y probatoria que en derecho corresponda y resuelva, de manera debidamente fundada, los extremos sometidos a su conocimiento. Dada la nulidad declarada y el reenvío ordenado, no se analizan los demás motivos de apelación ni los restantes agravios planteados.
