SUMMARY TREE-FELLING PROCEEDING (proceso sumario de derribo) brought by INVERSIONES PABOCE SOCIEDAD ANÓNIMA, corporate tax identification number 3-101-507383, represented by its President Karlina Bonilla Céspedes, of legal age, national identity card 2-466-0064, resident of Alajuela; against SANDRA ALVARADO ESPINOZA, of legal age, single, national identity card 6-178-178, resident of Alajuela. Attorney Mario Rosales Vargas serves as Public Defender for the plaintiff. Attorney Jesús Chaves Mora serves as Public Defender for the defendant. Proceedings conducted before the Agrarian Court of the First Judicial Circuit of Alajuela.

The opinion is drafted by Judge Fisher González; and,

WHEREAS:

I. CLAIMS

The plaintiff requests that judgment be rendered: "… IN FAVOR of this summary action and ordering the cutting of the trees — 3 TREES OF UNKNOWN SPECIES [sic] — or, as the case may be, their pruning. The cost of said work must be borne by the defendant. Should the defendant fail to assume such costs, the plaintiff be authorized to carry out the cutting and subsequently proceed to recover the cost of said cutting from the defendant." (See electronic case file, images 21 to 25).

II. RULING UNDER APPEAL

Judge Edgar Calvo Solano, of the Agrarian Court of the First Judicial Circuit of Alajuela, in judgment 2025000092 issued at eight hours and fifty-eight minutes on the twenty-seventh of May of two thousand and twenty-five, ruled: "THEREFORE: The present tree-felling proceeding is hereby granted as follows: 1) The defendant is ordered to cut down the three trees that are the subject of this proceeding within a period of two months; should additional time be needed for the cutting, the defendant must notify this court in advance. 2) The defendant is hereby warned that, should she fail to comply within the allotted time, the plaintiff is authorized to carry out the cutting at the defendant's expense. 3) The defendant must take all necessary precautions so that, at the time of cutting the trees, no damage is caused to the plaintiff's property or to nearby public infrastructure such as electrical lines. Immediate cutting of the three indicated trees is authorized. Given that both parties are represented by the Public Defender's Office, no special award of costs is made." (See electronic case file, images 93 to 95).

III.With respect to the sole fact found to be proven, and given the manner in which this matter will be resolved at this level of review, it is reformulated as follows: The trees that are the subject of this proceeding are located on the property parcel (finca) of the defendant, registered under parcel number (matrícula) 4-279646-000, along the boundary (colindancia) with the property in possession of the plaintiff, registered under parcel number 2-278787-000; the trees are situated outside the riparian protection zone (área de protección) of rivers or streams, such that the three trees show no observable structural damage at their base (technical report in images 73 to 86, record of judicial inspection in image 67).

IV.The defendant filed an appeal (recurso de apelación) expressly stating the grounds on which she challenges the position of the trial court. The grievances raised are as follows:

  • 1)It is important to bear in mind that the tree-felling proceeding is intended to determine whether a tree, due to its poor condition, poses an imminent risk of falling that endangers the life and safety of persons, their property, or public assets (Articles 310 of the Civil Code and 108 of the Code of Civil Procedure, applied supplementarily to this matter). The summary nature of such a proceeding is aimed at determining whether the tree must be removed in order to prevent a harmful situation that, absent such measures, has a high probability (imminence) of occurring at the present time or in the very near future. As prerequisites (presupuestos) for this type of proceeding, and with regard to the danger posed, the following must be established: a) That the tree whose felling is sought constitutes an imminent threat, due to the risk of falling, to the rights of the possessing party or to passersby (their integrity, life, or property), or that it may damage some thing or asset. b) Legal entitlement. Although the legal framework (ordenamiento jurídico) grants the right to fell dangerous trees, just cause must exist for doing so. In the case of a tree, given the environmental protection regulations currently in force in the country, it is necessary to verify that its cutting or pruning is truly necessary, such that the applicable prerequisites must be met, in order to avoid an illegal or unnecessary felling. In this regard, even if a tree is diseased or at risk of falling, if that event would not actually affect the integrity of persons or their property, its felling should not be authorized, since there is no other legally protected interest (bien jurídico) to safeguard; on the contrary, it may be necessary for the environmental balance of ecosystems to allow it to fall naturally. c) Present interest: the asset for whose felling authorization is sought must exist and the situation of imminent risk of falling must persist, both at the time the claim is filed and at the time judgment is rendered.
  • 2)It is of the utmost importance for this appeal that the tree-felling proceeding MUST NOT be used to resolve disputes arising from neighbor relations due to non-compliance with specific regulations concerning the minimum distance at which trees may be planted in relation to boundary lines, except insofar as it concerns the actual danger or risk of the entire tree or its branches falling (Articles 403 and 404 of the Civil Code). Disputes that may arise from root systems and other aspects that do not constitute factors capable of causing the imminent fall of the tree must be addressed through the appropriate procedural avenue, which is ordinarily a plenary proceeding, in order to guarantee due process (debido proceso) to the parties involved and on account of the type of evidence that is typically required for such matters.
  • 3)The technical assessment issued in this proceeding (SINAC report No. SINAC-ACC-OA-inf-0126-2025) is insufficient to demonstrate that there is an imminent danger or real threat posed by the trees at issue in this proceeding. Said assessment states: "it is an adult individual; no structural damage is observed at its base; however, it is surrounded by concrete on all sides, from which it is inferred that its roots may be constricted; 50% of the canopy extends over the dwelling of the plaintiff." The specialist's report does not establish that the trees pose an imminent risk of falling or that they are dangerous. No other evidentiary elements were submitted that would support the conclusion reached in the judgment under appeal. As highlighted in the appeal, the trial court acknowledges that there is no certainty as to when the tree might fall, yet chooses to preemptively authorize the felling, without taking into account that this type of proceeding requires the threat to be real and present — that is, that the risk of falling be imminent. As a living organism, it is logical that a tree may eventually be lost through falling. However, if it cannot be proven that such an event may occur at any moment in the present, the felling must not be unjustifiably anticipated.
  • 4)In this case, there is no sufficient evidence establishing a present risk that would justify the complete felling of the trees; accordingly, the prerequisites for a tree-felling proceeding are not met, and such action would cause harm to the environment, the biological landscape, and the preservation of the ecosystem (see electronic case file, images 99 to 103).

V.The appellant is correct. Pursuant to article 108.1 of the Code of Civil Procedure (Código Procesal Civil), applicable on a supplementary basis by virtue of what is prescribed in canon 79 of the Ley de Jurisdicción Agraria (the applicable statutory framework by reason of the provisions of Transitorio I of the Código Procesal Agrario), the summary tree-felling proceeding (proceso sumario de derribo) shall lie when the poor condition of a tree constitutes a threat to the rights of the possessor or passersby. Accordingly, that threat or risk to human safety must be demonstrated. In this case, the judicial site inspection (reconocimiento judicial) conducted established that the trees at issue are one laurel tree and two others, located within the property (finca) of the defendant party, registered under number 4-279646-000, but bordering the property held in possession by the plaintiff, registered under number 2-278787-000 (record at image 67).

Likewise, in forestry technical opinion (dictamen técnico forestal) No. SINAC-ACC-OA-inf-0126-2025, prepared by Engineer Pablo Montenegro Salas of the Área de Conservación Central, Reserva de Biosfera Cordillera Volcánica Central, dated March 7, 2025, those trees were examined and the following was recorded: "… they are located in the area of a dwelling that is not affected by any stream (quebrada) or river protection zone; the trees are situated on the north side of the dwelling, bordering the plaintiff's dwelling. Tree 1: it is an adult specimen; no structural damage is observed at its base; however, it is surrounded by concrete on all sides, which leads to the presumption that its roots may be compressed; 50% of the crown (copa) lies over the dwelling of the plaintiff party. Tree 2: it is likewise an adult specimen, with no observable damage at the base, with approximately 40% of its crown over the dwelling of the plaintiff party; leaves are observed on the ground, possibly due to the effect of wind.

Tree 3: it is likewise an adult specimen, with no observable damage at the base, with approximately 40% of its crown over the dwelling of the plaintiff party; leaves are observed on the ground, possibly due to the effect of wind… All of the trees are located less than 1 meter from the property of the plaintiff party; none of them is situated within river, stream, or spring (naciente) protection zones; they are not subject to any cutting restriction due to a moratorium or risk of extinction. Given the size of the specimens, these species are not considered suitable for small urban spaces, as they develop average heights exceeding 10 meters" (report at images 73 to 86). In this context, the appellant is correct that dangerousness was not demonstrated, as the specimens are healthy and present no appreciable structural damage of any kind. The A Quo held that, although the trees are healthy, the problem is that their crowns encroach upon the plaintiff's property, dropping leaves and branches onto the building and home, and that, being located one meter from the boundary (lindero) between the two estates (fundos) and capable of reaching a height of 10 meters, they present a problem with regard to their branching, which is why they are not suitable trees for urban areas (Considerando III of the judgment at images 94 and 95).

This view is not shared, because height alone or branching is not in itself a decisive element for ordering felling, since the phytosanitary condition (estado fitosanitario), structural condition, and whether the tree genuinely constitutes a threat must all be weighed. The report in no way establishes that risk, and although it suggests that this type of specimen should not be planted in urban areas due to the height they attain, it is nonetheless the case that it states the trees have no structural problems. Furthermore, although the expert noted that Tree No. 1 is surrounded by concrete, "which leads to the presumption that its roots may be compressed," this assertion should not be understood as an established risk, but rather, as the word indicates, a presumption that has in any event not been shown to affect the structural condition of the tree. Likewise, the fact that the crown of the three trees may extend into the airspace of the neighboring dwelling does not imply that an imminent danger has been demonstrated, as the trees are healthy and no detachment of branches was found to have occurred.

VI.On a separate matter, as the appellant alleges, article 403 of the Código Civil governs the planting of trees near a neighboring estate (heredad ajena), providing that they must be planted at least five meters from the boundary line (línea divisoria). Likewise, article 404 of that body of law provides: "If the branches of any trees extend over a neighboring estate, gardens, or yards, the owner thereof shall have the right to demand that they be cut insofar as they extend over their property; and if it is the roots of neighboring trees that extend into another's soil, the one in whose soil they penetrate may cut them within their own property independently." Accordingly, if the plaintiff's grievance relates to that type of problem, the summary tree-felling proceeding is not the appropriate avenue to pursue, as it is reserved for genuine scenarios of risk of the tree falling. Consequently, the grounds of appeal (agravios) are sustained and the judgment is reversed; in its place, the claim is dismissed in all its particulars. As regards the exemption from costs (exención en costas), the judgment is affirmed, given that the party had legitimate reasons to litigate by reason of the proximity of the trees, which warrants application of article 55 of the Ley de Jurisdicción Agraria.

Redacta la jueza Fisher González; y,

CONSIDERANDO:

I. DE LAS PRETENSIONES

La parte actora solicita que en sentencia se declare: «… CON LUGAR esta acción sumaria y se ordene la corta de los arboles 3 ARBOLES DE ESPECIE DESCONOCIDAD (sic) en su caso podar el mismo. El costo de dicha labora debe ser asumido por la parte demandada. En caso que esta no los asuma se autorice la corta por la parte actora para que luego se proceda al cobro de esta corta en contra de la parte demandada». (Ver expediente electrónico imágenes 21 a 25).

II. RESOLUCIÓN APELADA

El juez Edgar Calvo Solano, del Juzgado Agrario del Primer Circuito Judicial de Alajuela, en sentencia 2025000092 de las ocho horas cincuenta y ocho minutos del veintisiete de mayo de dos mil veinticinco, resolvió: «POR TANTO: Se declara con lugar el presente proceso de derribo de la siguiente manera: 1) Se ordena a la demandada que en el plazo de dos meses deberá cortar los tres árboles objeto de este proceso; en caso de necesitar más tiempo para la corta deberá comunicarlo con tiempo a éste despacho. 2) Se advierte a la parte demandada que en caso de no cumplir en el plazo otorgado queda autorizada la parte actora a realizar la corta de éstos a costa de la demandada. 3)La demandada deberá tomar todas las precauciones necesarias para que a la hora de cortar los árboles no se causen daños a la propiedad del actor, ni a los bienes públicos cercanos como el tendido eléctrico. Se autoriza la corta inmediata de los tres árboles indicados. Dado que ambas partes litigan con Defensa Pública se falla este proceso sin especial condenatoria en costas». III.En relación al único hecho tenido por probado, dada la forma como se resolverá en esta instancia, se reformula de la siguiente manera: Los árboles objeto de este proceso están situados dentro en la finca de la parte demandada matrícula 4-279646-000, pero en la colindancia con la finca en posesión de la actora matrícula 2-278787-000, los mismos se encuentran fuera del área de protección de ríos o quebradas, de forma tal que los tres árboles no presentan daños observables a nivel estructural en su base (informe en imágenes 73 a 86, acta de reconocimiento judicial en imagen 67).

IV.La parte demandada interpuso recurso de apelación con indicación expresa de las razones en que se apoya para refutar la tesis del juzgado de instancia. Los agravios formulados son los siguientes:

  • 1)Es importante tenerse presente que el proceso de derribo tiene por fin determinar si un árbol, por su mal estado, constituye un peligro inminente de caída que afecte la vida y seguridad de las personas, su patrimonio o bienes de naturaleza pública (numerales 310 del Código Civil y 108 Código Procesal Civil, aplicado supletoriamente a esta materia). La naturaleza sumaria de dicho proceso buscar determinar si ese árbol debe ser eliminado, para prevenir una situación dañina que, de no tomarse esas medidas, tiene un alto grado de probabilidad (inminencia) de acontecer en tiempo presente o muy cercano. Como presupuestos de este tipo de proceso y en relación a su peligrosidad, se requiere entonces que se compruebe: a) El árbol cuyo derribo se pretende constituya una amenaza inminente, por peligro de caída, para los derechos de la persona poseedora o para las transeúntes (integridad, vida o su patrimonio), o bien pueda perjudicar alguna cosa. b) Derecho. Si bien el ordenamiento jurídico concede el derecho de derribar árboles peligrosos, debe existir una causa justa para ello. Si se trata de un árbol, dada la normativa de protección ambiental vigente en el país, se requiere verificar que su corta o desrame sea realmente necesaria, por lo que se deben cumplir los presupuestos exigidos, para así evitar un derribo ilegal o innecesario. En ese sentido, aunque un árbol esté enfermo o con peligro de caída, si ese acto no afecta en realidad la integridad de las personas o su patrimonio, no debe autorizarse su derribo, pues no existe otro bien jurídico que tutelar y,por el contrario, puede ser necesario para el equilibrio ambiental de los ecosistemas, dejar que se caiga por causas naturales. c) Interés actual: el bien que se pide se permita sea derribado, debe existir y mantenerse la situación de peligro inminente de caída, tanto cuando se plantea la demanda como cuando se emite la sentencia.
  • 2)Es de suma importancia para esta apelación, que el proceso de derribo, NO debe ser utilizado para resolver problemas derivados de relaciones de vecindad, por incumplimiento de normativa específica referida a la distancia mínima en que se pueden sembrar árboles en función de las colindancias, salvo lo que concierne al peligro o riesgo real de caída del árbol total o de las ramas (numerales 403 y 404 Código Civil). Los conflictos que se puedan generar por raíces y otros aspectos, que no constituyan factores que pueda provocar la caída inminente del árbol, deben ser discutidos a través de la vía procesal pertinente, que usualmente es un ordinario, para garantizar el debido proceso a las partes involucradas y por el tipo de prueba que usualmente se requiere para ello.
  • 3)El criterio técnico emitido en este proceso (informe de funcionario de SINAC N° SINAC-ACC-OA-inf-0126-2025), es insuficiente para demostrar que existe un peligro eminente o amenaza real de los árboles de interés en este proceso. Dicho criterio indica: "es un individuo adulto, no se observan daños a nivel estructural en su base, sin embargo, se encuentra rodeado de concreto en todos sus costados por lo que se presume que sus raíces podrían estar aprisionadas, el 50 % de la copa se encuentra sobre la vivienda de la parte demandante". El informe del especialista no demuestra que los árboles representen un peligro inminente de caída o peligrosidad. Tampoco se aportaron otros elementos probatorios que permitan llegar a la conclusión emitida en la sentencia apelada. Como se resalta en la apelación, el Juzgado reconoce que no existe certeza del momento en que podrían caer el árbol, pero opta por anticiparlo, sin tomar en cuenta que en este tipo de proceso se requiere que la amenaza sea real y actual, es decir, que el riesgo de caída se inminente. Como ser vivo, resulta lógico que un árbol puede llegar a extinguirse por caída. Pero de no probarse que este suceso puede acontecer en cualquier momento actual, no debe procederse injustificadamente a adelantar la situación.
  • 4)En este caso, no existe prueba eficiente que determine un riesgo actual que justifique la corta total de los árboles, por lo anterior, no cumple con los presupuestos del derribo, y estaría afectando al ambiente, paisaje biológico y preservación del ecosistema (ver expediente electrónico imágenes 99 a 103).

V.Lleva razón el impugnante. De conformidad con el ordinal 108.1 del Código Procesal Civil, aplicable supletoriamente en virtud de lo preceptuado en el canon 79 de la Ley de Jurisdicción Agraria (normativa pertinente en razón de lo dispuesto en el Transitorio I del Código Procesal Agrario), el proceso sumario de derribo procederá cuando el mal estado de un árbol constituya una amenaza para los derechos del poseedor o los transeúntes. En virtud de ello, debe demostrarse esa amenaza o riesgo a la seguridad humana. En este caso se acreditó en el reconocimiento judicial practicado que se trata de un árbol de laurel y otros dos, situados dentro de la finca de la parte demandada matrícula 4-279646-000, pero en la colindancia con la finca en posesión de la actora matrícula 2-278787-000 (acta en imagen 67). De igual modo, en el dictamen técnico forestal No. SINAC-ACC-OA-inf-0126-2025 realizado por el Ingeniero Pablo Montenegro Salas, del Área de Conservación Central, Reserva de Biosfera Cordillera Volcánica Central, de fecha 7 de marzo del 2025, se revisaron esos árboles y se consignó lo siguiente: “… los mismos se encuentran en un área de una vivienda que no tiene afectación por área de protección de quebrada o río, los árboles se encuentran en el sector norte de la vivienda, colindando con la vivienda de la demandante.

Árbol 1: es un individuo adulto, no se observan daños a nivel estructural en su base, sin embargo, se encuentra rodeado de concreto en todos sus costados por lo que se presume que sus raíces podrían estar aprisionadas, el 50 % de la copa se encuentra sobre la vivienda de la parte demandante. Árbol 2: se trata de igual manera de un individuo adulto, sin daños observables a nivel de base, con un 40% aproximadamente de su copa sobre la vivienda de la parte demandante, se observa hojas en el suelo, posiblemente por efecto del viento. Árbol 3: se trata de igual manera de un individuo adulto, sin daños observables a nivel de base, con un 40% aproximadamente de su copa sobre la vivienda de la parte demandante, se observa hojas en el suelo, posiblemente por efecto del viento… Todos los árboles se encuentran a menos de 1 metro de distancia de la propiedad de la parte demandante, ninguno de ellos se encuentra en áreas de protección de ríos, quebradas o nacientes, no tiene restricción de corta por veda o peligro de extinción.

Por el porte de los individuos, dichas especies no se consideran aptos para espacios urbanos pequeños, ya que desarrollan alturas promedio superiores a los 10 metros” (informe en imágenes 73 a 86). En este orden de consideraciones, lleva razón el apelante que no se demostró la peligrosidad, pues los individuos se encuentran sanos sin ningún tipo de daño estructural apreciable. El A Quo consideró que si bien los árboles son saludables el problema es que sus copas invaden la propiedad de la actora arrojando hojas y ramas sobre el inmueble y casa, además de que se encuentran a un metro del lindero entre ambos fundos, y que al poder alcanzar 10 de altura presentan problema con respecto a sus ramificaciones, de ahí que no sean árboles aptos para zonas urbanas (considerando III de sentencia en imágenes 94 y 95). Tal criterio no se comparte porque la altura por sí misma o sus ramificaciones no es un elemento contundente per se para ordenar la corta, ya que debe ponderarse el estado fitosanitario, estructural y si constituye realmente una amenaza.

El informe en manera alguna dictamina ese riesgo y aunque sugiere que este tipo de especímenes no deberían de estar sembrados en zonas urbanas debido a la altura que alcanzan, es lo cierto que menciona que los árboles no tienen problemas estructurales. Por otro lado, aunque el experto señaló que en cuanto al árbol No. 1 el mismo está rodeado de concreto “por lo que se presume que sus raíces podrían estar aprisionadas”, tal afirmación no debe entenderse como un riesgo, sino como la palabra lo indica, una presunción que en todo caso no se ha evidenciado afecte la condición estructural del árbol. Asimismo, el hecho de que la copa de los tres árboles pueda estar en el espacio aéreo de la vivienda colindante, no implica se haya demostrado un peligro inminente, pues los árboles se encuentran sanos y no se constató que se hubiesen desprendido ramas.

VI.En otro orden de ideas, tal y como lo alega el impugnante, el ordinal 403 del Código Civil regula lo relativo a árboles plantados cerca de la heredad ajena, disponiendo que deberán de sembrarse a cinco metros de la línea divisoria. De igual modo, el artículo 404 de ese cuerpo legal establece: “Si las ramas de algunos árboles se extienden sobre la heredad, jardines o patios vecinos, el dueño de éstos tendrá derecho a exigir que se corten, en cuanto se extiendan sobre sus propiedades; y si fueren las raíces de los árboles vecinos las que se extienden en el suelo de otro, aquel en cuyo suelo se introducen podrá cortarlas dentro de su propiedad por sí mismo”. De ahí que, si la disconformidad de la actora se relaciona con ese tipo de problema, no es la vía sumaria de derribo la que se deba utilizar pues ésta está reservada a supuestos reales de riesgo de caída. Por consiguiente, se acogen los agravios y se revoca la sentencia para en su lugar declarar la demanda sin lugar en todos sus extremos. En cuanto a la exención en costas se confirma el fallo, dado que a la parte la asistieron motivos para litigar en razón de la cercanía de los árboles, por lo que amerita la aplicación del ordinal 55 de la Ley de Jurisdicción Agraria.

POR TANTO

Se revoca la sentencia para en su lugar rechazar la demanda en todos sus extremos. En cuanto a la exención en costas se confirma el fallo.
