THE STATE N° 2025010055 ADMINISTRATIVE AND CIVIL FINANCIAL COURT, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at eleven hours and twenty-one minutes of October twenty-second, two thousand twenty-five.- Having reviewed the lack of jurisdiction (incompetencia) alleged by the representative of INDUSTRIAS INFINITO S.A., it is resolved:

CONSIDERING:

I. PROCEDURAL ACTIONS

The following are deemed relevant as such:

• 1)The representative of INDUSTRIAS INFINITO S.A. alleges the Court's lack of jurisdiction to enforce judgment 4933-2010 and requests that the proceeding be remitted to the Constitutional Chamber so that it may continue with the enforcement. (See enforcement file).
• 2)By resolution of fourteen hours and forty-four minutes of July seventh, two thousand twenty-five, a hearing was granted regarding the alleged lack of jurisdiction; all parties expressed their opposition to it. (See enforcement file). 3) The prescriptions of Law have been observed in the proceedings, and no defects or omissions capable of producing nullity of what has been done or causing defenselessness for any party are noted.- II.- REGARDING THE ALLEGED LACK OF JURISDICTION: INDUSTRIAS INFINITO S.A. bases its argument on the existence of the proceeding processed before the Constitutional Chamber under number 19-0011277-007-CO, whose enforcement is being processed in the Constitutional Jurisdiction, given that the judgment issued in said proceeding bears similarity to the judgment being enforced and issued in the cognition proceeding that gave rise to this enforcement, considering that the joint enforcement of both judgments guarantees adequate planning and efficacy in repairing the environmental damage caused. In relation to this argument, although the Court understands the purpose of the representative of INDUSTRIAS INFINITO S.A., there is a norm establishing that the enforcement of judgments issued by the Court must be carried out by the body of judges that the Court has for such purposes, and therefore there is no way to decline a jurisdiction granted by the Political Constitution in its Article 49 and the law, in this case Title VIII of the Administrative Contentious Procedure Code and specifically Articles 155, 156, and 157, among others, of said norm, without any doubt that the legal jurisdiction to enforce the judgments issued by the trial sections of this Court falls upon the enforcement judges who form part of the same jurisdiction. Now, in the specific case, this judge understands that the reasons alleged by the party are more of opportunity and convenience than legal ones, but since no legal reason exists that would allow this Court to decline its jurisdiction to hear the enforcement of a judgment, much less to sustain a conflict of jurisdiction with the Constitutional Chamber, the appropriate course is the rejection of the alleged lack of jurisdiction.

THEREFORE

For the reasons given, the lack of jurisdiction alleged by INDUSTRIAS INFINITO S.A. is rejected. Once this resolution is final, continue with the corresponding processing of this matter. EL ESTADO N° 2025010055 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las once horas con veintiuno minutos del veintidos de Octubre del dos mil veinticinco.- Vista la incompetencia alegada por la representación de INDUSTRIAS INFINITO S.A., se resuelve:

CONSIDERANDO:

I. ACTUACIONES PROCESALES

Como tales y de relevancia se tienen:

• 1)La representación de INDUSTRIAS INFINITO S.A., alega incompetencia del Tribunal para ejecutar la sentencia4933-2010 y solicita se remita el proceso a la Sala Constitucional para que esta continué con la ejecución. (Ver legajo de ejecución).
• 2)Mediante resolución de las catorce horas cuarenta y cuatro minutos del siete de julio de dos mil veinticinco, se confirió audiencia de la incompetencia alegada todas las partes manifestaron su oposición a la misma. ( Ver legajo de ejecución ) 3) En los procedimientos se han observado las prescripciones de Ley, y no se notan vicios u omisiones que sea capaces de producir nulidad de lo actuado, o pueda producir indefensión para alguna de las partes.- II.- SOBRE LA INCOMPETENCIA ALEGADA: INDUSTRIAS INFINITO S.A., basa su argumentación en la existencia del proceso tramitado ante la Sala Constitucional bajo el número 19-0011277-007-CO, cuya ejecución se esta tramitando en la Jurisdicción Constitucional, siendo que las sentencia dictada en dicho proceso guarda similitud con la sentencia que se ejecuta y fue dictada en el proceso de conocimiento que dio lugar a esta ejecución, al considerar que la ejecución conjunta de ambas sentencias garantiza una adecuada planificación y eficacia en la reparación del daño ambiental ocasionado. En relación a esta argumentación si bien el Tribunal comprende el propósito de la representación de INDUSTRIAS INFINITO S.A., existe una norma que establece que la ejecución de las sentencias dictadas por el Tribunal deben ser ejecutadas por el cuerpo de jueces que para dichos efectos posee el Tribunal, por lo que no existe modo alguno de que se decline una competencia dada por la Constitución Política en su artículo 49 y la ley en este caso el Titulo VIII del Código Procesal Contencioso Administrativo y en especifico los artículos 155, 156 y 157 entre otros, de dicha norma, sin que exista duda alguna que la competencia legal para ejecutar las sentencias dictadas por las secciones de juicio de este Tribunal recae en los jueces ejecutores que forman parte de la misma jurisdicción. Ahora bien en el caso especifico comprende esta juzgadora que las razones alegadas por la parte son más de oportunidad y conveniencia que legales, pero dado que no existe una razón jurídica que permita a este Tribunal declinar su competencia para concocer la ejecución de sentencia y mucho menos sostener un conflicto de competencia con la Sala Constitucional, lo que procede es el rechazo de la incompetencia alegada.

POR TANTO

Por las razones dadas se rechaza la incompetencia alegada por INDUSTRIAS INFINITO S.A., firme la presente resolución continúese con el tramite correspondiente de este asunto.
