Appeal filed in the present case number 25-0000299-1260-PE, brought against [Nombre 001], national identity card number [Valor 001], born on October 3, 1979, son of [Nombre 002] and [Nombre 003], for the offense of ILLEGAL TRANSPORTATION OF TIMBER OR FOREST PRODUCTS to the detriment of NATURAL RESOURCES. The judges José Manuel Cisneros Mojica, Víctor Francisco Cruz López, and Judge Cynthia Dumani Stradtmann participate in the decision on this appeal. Attorney Nancy Salguero Caicedo, representative of the Public Prosecutor's Office (Ministerio Público), appeared before this court.
FINDINGS
I.By judgment number 210-2025 of 13:07 hours on June 30, 2025, the In Flagrante Delicto Court (Tribunal de Flagrancia) of the Second Judicial Circuit of Guanacaste, Santa Cruz seat, ruled: POR TANTO: "Based on the foregoing and in accordance with Articles 39 and 41 of the Political Constitution, Article 8 of the American Convention on Human Rights, Articles 1, 30, 31, and 45 of the Penal Code, Articles 56 and 63(a) of the Ley Forestal, Articles 1 through 6, 180 through 184, 265 et seq., 326 et seq., 360, 361, 363, 365 and 366, and 422 et seq. and 490 of the Code of Criminal Procedure, and other cited provisions, [Nombre 001] IS ACQUITTED OF ALL PENALTY AND RESPONSIBILITY for the commission of the acts that the Public Prosecutor's Office attributed to him in this case and that were classified as the offense of ILLEGAL TRANSPORTATION OF TIMBER OR FOREST PRODUCTS to the detriment of FOREST RESOURCES.
The defendant [Nombre 001] is ordered to have returned to him the timber that was seized from him by the Public Force (Fuerza Pública), without prejudice to the rights that third parties may have over it. Regarding this case, the defendant is at liberty and the cessation of any currently in-force personal precautionary measures issued against him is ordered. This matter is resolved without a special award of costs. The costs of the proceedings are charged to the State. Once this ruling becomes final, the State Forestry Administration (Administración Forestal del Estado) shall be notified of the return of the timber ordered herein, and the case file shall be archived. Upon its oral delivery, the parties are hereby notified of the full content of this judgment and, if they deem it necessary, they may obtain a copy, for which they must provide the data storage medium of their choice (in the event they lack the financial resources to do so, with prior authorization from the Judicial Branch Administration, the court may provide them with a DVD-format disc).
The parties are hereby informed that the Criminal Appellate Court of Guanacaste is not a 100% virtual office, and therefore processes matters submitted to it in physical form; accordingly, during the appellate stage, motions must be filed directly at that office or at the Document Reception Office of the corresponding judicial circuit. II.Against the foregoing ruling, attorney Nancy Salguero Caicedo, representative of the Public Prosecutor's Office, filed an appeal.
III.The corresponding deliberation having been carried out in accordance with the provisions of the Code of Criminal Procedure, the Court considered the issues raised in the appeal.
Opinion drafted by Judge Cisneros Mojica; and,
CONSIDERING
I.Against the judgment on appeal, attorney Nancy Salguero Caicedo, representing the Public Prosecutor's Office, filed a single ground of appeal alleging: "lack of factual reasoning due to erroneous application of the substantive rule, specifically numerals 35, 56, and 63(a) of the Ley Forestal" (folio 44 reverse). The appellant notes that the Public Prosecutor's Office charged the accused [Nombre 001] with transporting 1866 board-feet of Costa Rican timber equivalent to 4,06 m³ of sawn timber (madera aserrada) of the Melina species, on June 11, 2025, in the [...] area, without holding forest exploitation permits (permisos de aprovechamiento forestal) or a certificate of origin (certificado de origen) for transporting the timber. According to the appellant, the trial judge acquitted the defendant on the grounds that the typical form of illegal timber transportation only criminalizes the transportation of products originating from a forest or plantation, a circumstance that was not included in the charging document.
The appellant, relying on multiple rulings of the Third Chamber (Sala Tercera) and the Criminal Appellate Court of Guanacaste, argues that the environmental criminal provision requires the transporter, regardless of whether the product is in the form of log timber (madera en troza), squared timber (escuadrada), or sawn timber, to hold the corresponding permits or the respective certificates of origin. The ground of appeal must be upheld. After carefully examining the prosecution's complaint, this Chamber undertook to listen to the judgment, delivered orally as required by the expedited flagrante delicto procedure, in which the judge released the defendant from liability, as the appellant had indicated in advance, on the grounds that the charging document contained an essential defect in that it lacked any allegation regarding the origin of the timber products being transported. The lower court's theory holds that the extraction and transportation of forest resources (recursos forestales) are only protected under the law when they come from either a forest or a plantation, developing in its judgment the normative concept of agroforestry plantation (plantación agroforestal).
However, it can be verified that the prosecution's charging document states, insofar as relevant, that the transportation was carried out "without holding forest exploitation permits, an invoice demonstrating lawful acquisition, and without complying with the requirements set forth in Article 55 of the Ley Forestal"; that provision reads:
"Any natural or legal person who possesses log timber, squared timber, or sawn timber for purposes of conducting their activities must prove that the forest product is covered by the respective exploitation permit where applicable, or demonstrate its origin, when requested by the State Forestry Administration. The forest industry that processes log timber, squared timber, or sawn timber for purposes of conducting its activities must supply the State Forestry Administration and the National Forestry Office (Oficina Nacional Forestal) with such technical and statistical information as those bodies deem appropriate." In this regard, as part of the protection of forest resources, the State has imposed on regulated parties the obligation to demonstrate the origin of timber products. The provision's objective, in any case, is to establish the traceability (trazabilidad) of the natural resource, with the purpose of ensuring that the extraction of the timber has not violated the environmental protection standards set by the relevant authorities.
That said, the lower court's theory — according to which the origin must be alleged in order for the elements of Article 63(a) to be satisfied (which penalizes non-compliance with Article 56 of the law under discussion) — is inaccurate, as it disregards the fact that Article 30 of the Regulations to Ley 7575 refers to timber from a forest plantation or an agroforestry system, while Article 31 sets forth the requirements "for the transportation of log timber, block, or squared timber not covered by the preceding article"; in other words, documentation is always required to transport timber, and the absence of such documentation is precisely what is penalized by Article 56 in conjunction with Article 63(a) of the Ley Forestal; given that regulated parties have the obligation to demonstrate origin, which would not even exclude the cases covered by Article 28 of the said regulation, which exempts from obtaining a permit for the felling or transportation of trees from forest plantations or individually planted trees.
One thing is not requiring felling and exploitation permits, and another is the obligation to demonstrate origin for lawful transportation. For the foregoing reasons, the judgment on appeal must be annulled and the case remanded to the court of origin for it to evaluate the legal situation of [Nombre 001], in accordance with the rules governing the retrial (juicio de reenvío), including the bearing that the existence of an invoice apparently issued by a commercial establishment engaged in timber sales may have on the defendant's version of events; regarding this last point, it should be noted that the defendant's version was not assessed, which is noted here by virtue of the obligation to conduct a comprehensive review of the judgment, this constituting a serious defect. In that regard, it is noted that the defendant stated that he is a transporter who hauls freight, that he was hired by a person to transport timber from a sawmill and timber depot to an address in Nicoya that the person had provided to him, that at the time of the transportation he did not have the original invoice on his person, but that he submitted it to the proceedings as corroboration of his account.
Without prejudging the matter, it must be borne in mind that the prosecution's argument in its appeal (to the effect that the invoice lacked required elements, among them, not being an electronic invoice) runs counter to the general principle of freedom of evidence (principio general de libertad probatoria), as it conflates the administrative and tax requirements for an invoice with the usefulness that this document could have in supporting the defense theory, which falls between compliance with a requirement (such as holding an invoice from an authorized establishment) and mistake of law (error de prohibición) (on the grounds that the defendant believed himself authorized by the legitimate owner to carry out the transportation). In summary, all transportation of squared timber, log timber, or sawn timber requires the transporter to demonstrate origin; and depending on the circumstances, that demonstration is effected by presenting the certificate of origin, exploitation permit, or the relevant invoice.
For this appellate body, it is impossible to resolve the merits in this forum, since the determination of the evidentiary weight to be given to the submitted invoice and to the defendant's account obliges the holding of a new adversarial hearing (contradictorio) so that the parties may engage in broad debate on these issues as they arise, and to ensure that whatever is decided carries the right of appeal guaranteed by the Inter-American Convention on Human Rights and Costa Rican criminal procedural law.
POR TANTO
The appeal filed by attorney Nancy Salguero Caicedo on behalf of the Public Prosecutor's Office is upheld. The judgment on appeal is annulled and the holding of a new trial is ordered so that the legal situation of the defendant may be resolved. Notify the parties.

Movilización de madera de bosque o plantación sin permisos VOTO 2025-450 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL DE GUANACASTE. Santa Cruz, a las catorce horas y veinte minutos del veintitrés de octubre de dos mil veinticinco.
Recurso de apelación interpuesto en la presente causa número 25-0000299-1260-PE, seguida contra [Nombre 001], cédula de identidad [Valor 001], nacido el 03 de octubre de 1979, hijo de [Nombre 002] y [Nombre 003], por el delito de MOVILIZACIÓN ILEGAL DE MADERA O DE PRODUCTOS FORESTALES en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso los jueces José Manuel Cisneros Mojica, Victor Francisco Cruz López y la jueza Cynthia Dumani Stradtmnann. Se apersonó en esta sede, la licenciada Nancy Salguero Caicedo, representante del Ministerio Público.
RESULTANDO
I.Mediante sentencia número 210-2025 de las 13:07 horas del 30 de junio de 2025, el Tribunal de Flagrancia del Segundo Circuito Judicial de Guanacaste, sede Santa Cruz, resolvió: POR TANTO: "Con base en lo expuesto y de conformidad con los artículos 39 y 41 de la Constitución Política, 8 de la Convención Americana de Derechos Humanos, 1, 30, 31 y 45 del Código Penal, 56 y 63 inciso a) de la Ley Forestal, 1 al 6, 180 a 184, 265 y siguientes, 326 y siguientes, 360, 361, 363, 365 y 366 y 422 y siguientes y 490 del Código Procesal Penal y demás citados, SE ABSUELVE DE TODA PENA Y RESPONSABILIDAD a [Nombre 001] de la comisión de los hechos que el Ministerio Público le atribuyó en esta causa y que fueron calificados como el delito de MOVILIZACIÓN ILEGAL DE MADERA O DE PRODUCTOS FORESTALES en perjuicio de LOS RECURSOS FORESTALES. Se ordena devolver al imputado [Nombre 001] la madera que le fue decomisada por la Fuerza Pública, sin perjuicio de los derechos que terceras personas pudieran tener sobre la misma.
En relación con esta causa, el imputado se encuentra en libertad y se ordena el cese de cualesquiera medidas cautelares de carácter personal dictadas en su contra que estén vigentes. Se resuelve este asunto sin especial condena en costas. Son los gastos del proceso a cargo del Estado. Firme esta resolución, comuníquese a la Administración Forestal del Estado la devolución de la madera aquí ordenada y archívese el expediente. Con su dictado oral, las partes quedan notificadas del contenido íntegro de esta sentencia y, de estimarlo necesario, pueden obtener una copia, para lo cual deben aportar el medio de almacenamiento informático de su elección (en caso de no contar con recursos económicos para ello, previa autorización de la Administración del Poder Judicial, el tribunal podrásuministrarles un disco formato DVD). Se hace saber a las partes que el Tribunal de Apelación de Sentencia Penal de Guanacaste no es un despacho 100 % virtual, por lo que tramita los asuntos sometidos a su conocimiento de manera física; en razón de lo anterior, durante la etapa de impugnación, las gestiones deben ser presentadas directamente en ese despacho o en la Oficina de Recepción de Documentos delcorrespondiente circuito judicial. Lic. Carlos Bermúdez Chaves. JUEZ DE JUICIO. cbermudezc." (SIC).
II.Contra el anterior pronunciamiento la licenciada Nancy Salguero Caicedo, representante del Ministerio Público, interpuso recurso de apelación.
III.Verificada la deliberación respectiva de conformidad con lo dispuesto en el Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso.
Redacta el juez Cisneros Mojica; y,
CONSIDERANDO
I.Contra el fallo venido en alzada la licenciada Nancy Salguero Caicedo, en representación del Ministerio Público, interpuso un único motivo de apelación alegando: “falta de fundamentación fáctica por errónea aplicación de la norma sustantiva, propiamente los numerales 35, 56 y 63 inciso a de la ley forestal” (folio 44 vuelto). Advierte la recurrente que el ministerio fiscal acusó al sindicado [Nombre 001] por transportar 1866 “pulgadas de madera tica” equivalentes a 4,06 m³ de madera aserrada de la especie Melina, el día 11 de junio del año 2025, en el sector de [...], sin contar con los permisos de aprovechamiento forestal o certificado de origen para movilizar la madera. Según informa la recurrente, el juez sentenciador absolvió al imputado estimando que la forma típica del transporte ilegal de madera solamente sanciona de forma penal la movilización de productos cuyo origen sea bosque o plantación, circunstancia que no se incluyó en la pieza acusatoria.
Para la quejosa con apoyo en múltiples votos de la Sala Tercera y del Tribunal de Apelación de Sentencia Penal de Guanacaste, la norma penal ambiental demanda que el transportista, con independencia de que el producto se encuentre en trozas, aserrado o es cuadrado, cuente con los permisos correspondientes o los certificados de origen respectivos. El motivo se debe declarar con lugar. Luego de examinar cuidadosamente el reclamo de la fiscalía esta Cámara se dio a la tarea de escuchar la sentencia, dictada oralmente conforme lo establece el procedimiento expedito de flagrancia, en ella el juez liberó de responsabilidad al imputado, tal y como lo había adelantado la recurrente, por considerar que la acusación contenía un defecto esencial al carecer de la imputación del origen de los productos maderables transportados. La tesis del tribunal afirma que sólo se tutela la extracción y el transporte de los recursos forestales cuando provienen ya sea de un bosque o de una plantación, desarrollando en su fallo el concepto normativo de plantación agroforestal.
Sin embargo se puede verificar que la acusación fiscal sostiene, en lo que interesa, que el transporte se lleva a cabo “sin contar con permisos de aprovechamiento forestal, factura que demostrase su legítima adquisición y sin cumplir con los requisitos que establece el artículo 55 de la ley forestal”; este guarismo señala:
“La persona física o jurídica que posea madera en troza, escuadrada o aserrada, para realizar sus actividades, deberá comprobar que el producto forestal está amparado por el respectivo permiso de aprovechamiento cuando proceda o bien, demostrar su procedencia, cuando la Administración Forestal del Estado lo solicite. La industria forestal que procese madera en troza, escuadrada o aserrada para realizar sus actividades, deberá suministrar a la Administración Forestal del Estado y a la Oficina Nacional Forestal la información técnica y estadística que estas consideren conveniente”.
Al respecto, como parte de la tutela de los recursos forestales, el Estado impuso a los administrados la obligación de demostrar el origen de los productos maderables. La norma tiene como objetivo, en todo caso, establecer la trazabilidad del recurso natural, con el propósito de garantizar que la extracción de la madera no ha contravenido los estándares de protección ambiental fijados por las autoridades correspondientes. Dicho lo anterior, la tesis del tribunal de instancia, según la cual debe imputarse el origen, para tener por satisfechos los elementos del artículo 63 inciso a, (que sanciona el incumplimiento del artículo 56 de la ley de comentario) resulta inexacta, pues deja de lado que, el artículo 30 del reglamento a la ley número 7575, se refiere a la madera proveniente de una plantación forestal o un sistema agroforestal y el numeral 31 dispone los requisitos “para la movilización de madera en troza, en bloc o escuadrada, no comprendidos en el artículo anterior”, con otras palabras, siempre se necesita documentación para transportar madera y la ausencia de esta es, precisamente, la que se sanciona por el artículo 56 en relación con el 63 inciso a de la Ley Forestal; pues el administrado tiene la obligación de acreditar el origen, lo que no excluiría, ni siquiera los supuestos del numeral 28 de la norma de marras, que exime de obtener permiso para la corta o el transporte cuando se trate de árboles de plantaciones forestales o plantados individualmente.
Una cosa es no requerir permisos de tala y aprovechamiento y otra es la obligación de acreditar el origen para su transporte legítimo. Por lo anterior la sentencia venida en alzada debe ser anulada y remitir la causa nuevamente al tribunal de origen para que evalúe la situación jurídica de [Nombre 001], de conformidad con las reglas del juicio de reenvío, incluida la incidencia que puede tener en su versión defensiva la existencia de una factura emitida en apariencia por un local comercial dedicado a la venta de madera; en cuanto a esto último debe señalarse que la versión del imputado no fue valorada, lo que se apunta aquí en virtud de la obligación de realizar una revisión integral del fallo y ser éste un vicio grave. En esa dirección véase que el justiciable indicó ser un transportista que hace fletes, que fue contratado por una persona para realizar el traslado de una madera desde un aserradero y depósito de maderas hasta una dirección en Nicoya que él le había proporcionado, que al momento del transporte no contaba consigo con la factura original, pero el mismo la aportó al proceso como parte del respaldo de su dicho.
Sin prejuzgar al respecto, debe tenerse en cuenta que el argumento de la fiscalía en su recurso de apelación (según el cual esa factura carecía de requisitos, entre otros, no ser electrónica), contraviene el principio general de libertad probatoria, al confundir los requisitos administrativos/tributarios de la factura, con la utilidad que podría tener este documento para acreditar la tesis defensiva, que se encuentra entre el cumplimiento de un requisito (como lo es contar con la factura del local autorizado) y el error de prohibición (considerando que está autorizado por el legítimo propietario para realizar el transporte). En síntesis, todo transporte de madera escuadrada, en trozas o aserrada, requiere la demostración del origen por parte del transportista; y según las circunstancias, esa demostración se materializa con la exhibición del certificado de origen, permiso de aprovechamiento o la factura respectiva.
Para este órgano de alzada, es imposible resolver sobre el fondo en esta Sede, pues la determinación del valor que debe darse a la factura presentada y a la versión del imputado como elementos de prueba, obligan a la celebración de un nuevo contradictorio para que las partes puedan mantener un debate amplio sobre estos temas, conforme se presenten, y garantizarse que lo que se resuelva cuente con el recurso de apelación garantizado por la Convención Interamericana de Derechos Humanos y la normativa procesal penal costarricense.
POR TANTO
Se declara con lugar el recurso de apelación interpuesto por la licenciada Nancy Salguero Caicedo en representación del ministerio público. Se anula sentencia venida en alzada y se dispone la celebración de un nuevo juicio para que se resuelva la situación jurídica del imputado. Notifíquese.
