MARIA JULIA ALVARADO ROJAS N° 2025006784 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, at fifteen hours and twenty-three minutes on ocho de julio del dos mil veinticinco.- Proceeding to invalidate an act harmful to the public interest (proceso de lesividad) brought by THE STATE, represented by State Attorney Ana Vanessa Mora Carvajal (img. 16 of the folder), against Ms. MARÍA JULIA ALVARADO ROJAS, identification card 02-0560-0680, represented by her special counsel for judicial proceedings (apoderadas especiales judiciales), Sonia Madrigal Fernández, bar card 3250, and Noemy Zulay Linkemer Fonseca, bar card 3464 (img. 136).

WHEREAS:

PROCEDURAL ACTIONS.- The following are relevant to the resolution of this proceeding:

In a filing submitted to the Tribunal Contencioso Administrativo y Civil de Hacienda on 11 de marzo del 2019, the State brought an ordinary proceeding to invalidate an act harmful to the public interest (demanda ordinaria de lesividad) against Ms. María Julia Alvarado Rojas and, based on the facts presented and the legal grounds asserted, requested that the judgment declare the following (img. 2-14. These claims were neither modified nor clarified at the preliminary hearing):

“a. The absolute nullity (nulidad absoluta) of decision N.º R-DRH-AJ-266-2011, issued at 8:00 hours on 13 de octubre de 2011 by the Ministerio de Ambiente y Energía, and of its related acts.

b. The immediate inapplicability of the Risk in the Exercise of the Judicial Function incentive, granted in decision N.º R-DRH-AJ-266-2011, issued at 8:00 hours on 13 de octubre de 2011 by the Ministerio de Ambiente y Energía, and of its related acts.

c. That the defendant be ordered to pay both categories of costs (ambas costas), together with the amounts accruing thereon from the date they become due until actual payment.” By order issued at 13:29 hours on 21 de febrero del 2019, the complaint was served upon the respondent (img. 17-19).

In a filing submitted to the Tribunal on 3 de abril del 2019, the defendant denied the complaint and raised the defenses of lack of legal entitlement (falta de derecho), defective filing of the complaint, expiration (caducidad), and statute of limitations (prescripción) (img. 23-42).

The preliminary hearing was held on 2 de julio del 2019. At that hearing, the defendant was granted an opportunity to submit written comments concerning the administrative record (expediente administrativo), and the claims were established as set forth in the complaint. Likewise, by decision number 1130-2019, the case-management judge (persona juzgadora de trámite) rejected the defense based on formal defects in the complaint and deferred the expiration and statute-of-limitations defenses for determination in the judgment on the merits because they were not evident and manifest. The documentary evidence was subsequently admitted, and the testimonial evidence offered was rejected. Oral closing arguments were not heard; instead, they were received in written submissions dated 16 de julio de 2019 (img. 132-135, 147-157, 158-177 and recording of the oral hearing).

Pursuant to the implementation process for the redesign of the Tribunal Contencioso Administrativo y Civil de Hacienda proposed by the Dirección de Planificación del Poder Judicial and approved by the Consejo Superior, under resolutions XXVIII of Session N° 84-2021 of 28 de setiembre de 2021 and XXXIX of Session N° 95-2021 of 04 de noviembre de 2021, criteria were established for distributing the caseload of proceedings awaiting judgment. Under those criteria, beginning on diecisiete de julio de 2023, the Tribunal’s Coordinating Office simultaneously reassigned a large number of case files, including this pure question of law case (Puro Derecho), which was assigned to Judge Conejo Cantillo. The matter is therefore decided in accordance with the priority policies established by the Corte Plena (certification, img. 181).

The mandatory procedural requirements have been observed, and no defects or omissions capable of causing nullity or denying the parties an opportunity to defend themselves are apparent. Judge Conejo Cantillo drafts the opinion, with Judges Irías Obando and Díaz Anchía concurring.

PROVEN FACTS.- The following facts are deemed duly established and relevant to the resolution of this matter, as they are supported by the evidence cited in support thereof:

On 16 de agosto del 2011, the plaintiff submitted the following request to the Departamento de Recursos Humanos del Ministerio de Ambiente y Energía (img. 96):

“I hereby most respectfully request that you undertake the appropriate steps for me to be granted the 18% incentive corresponding to recognition for the exercise of the judicial function.

This is because, beginning próximo 16 de setiembre, I will take up my duties at the Tribunal Ambiental Administrativo.” Ms. María Julia Alvarado Rojas began working as an employee of the Ministerio de Ambiente y Energía in the position of “Profesional de Servicio Civil 1-A,” position number 357532, at the Tribunal Ambiental Administrativo, on 16 de septiembre de 2011 (img. 97, 100).

In decision number R-DRH-AJ-266-2011, issued at 08:00 hours on 13 de octubre del 2011, the then Acting Ministra de Ambiente y Energía, Lorena Guevara Fernández, ruled as follows (img. 97-99):

“…the administrative claim (reclamo administrativo) filed by María Julia Alvarado Rojas […] is granted with respect to the 18% salary supplement (Plus Salarial) known as Risk in the Exercise of the Judicial Function, corresponding to her position; the Departamento de Recursos Humanos is therefore ordered to initiate the appropriate administrative procedures so that the benefit is recognized retroactively from the time the claim was filed.” This decision was based on decision number 1880-96 of the Sala Constitucional, issued at 15:51 hours on 24 de abril de 1996, which granted that benefit to the members of the Tribunal Fiscal Administrativo.

By official letter DM-350-2014, dated 03 de septiembre del 2014, the then Ministro de Ambiente y Energía, Edgar Gutiérrez Espeleta, submitted the following questions to the Procuraduría General de la República (img. 111-112):

“1. Is it legally permissible to grant the risk incentive for the exercise of the judicial function to employees of the Tribunal Ambiental Administrativo? If so, who is eligible to receive it?

2. If the risk incentive for the judicial function has been granted to employees of the Tribunal Ambiental Administrativo by administrative decision, what happens in the cases in which it is currently being paid?

3. Upon expiration of the 06-year term for which the three members of the Tribunal Ambiental Administrativo are appointed, or if they are removed before the end of that term, must the Public Administration pay amounts for notice of termination (preaviso) and severance pay (cesantía)?” In Opinion C-257-2015 of 16 de septiembre del 2015, the Procuraduría General de la República addressed the inquiry submitted by the Ministro de Ambiente y Energía through official letter DM-350-2014, referenced in the preceding fact, and concluded as follows (img 113-126):

“If there is no law establishing salary parity (equiparación salarial) between the members of the Tribunal Ambiental Administrativo and the members of the Tribunales Superiores del Poder Judicial, the salary components granted to members of the Tribunales del Poder Judicial, including the risk incentive for exercising adjudicative functions, cannot be granted to members of the Tribunal Ambiental Administrativo. It is not legally permissible for the Ministerio de Ambiente y Energía to recognize the risk incentive for the exercise of the judicial function as a vested right (derecho adquirido) of employees of the Tribunal Ambiental Administrativo, because that incentive does not become a permanent component of the employees’ salaries but is instead subject to requirements or conditions, such as, in the case of administrative tribunals, parity between the salaries and positions of their personnel and those of the Poder Judicial.

Accordingly, if the public employee does not meet the established conditions, payment of the incentive must be denied; if it has been granted through an administrative decision, as in the matter under consultation, it must cease. If the salary supplement was granted through an administrative decision, the Administration must, in order to terminate it, follow the procedure established in Article 173 of the Ley General de la Administración Pública or, as applicable, in Articles 10.5, 34, and 39.2 of the Código Procesal Contencioso Administrativo.” In decision R-0179-2018-MINAE, issued at 13:00 on 11 de junio del 2018, the Ministerio de Ambiente y Energía ruled as follows (img. 127-130):

“FIRST: Based on all the foregoing factual and legal considerations [sic], the act granting payment of the risk incentive for the exercise of the judicial function to Ms. María Julia Alvarado Rojas is hereby declared harmful to the State’s economic interests.” This decision was justified on the ground that the act was based on an administrative decision, which was in turn based on Decreto Ejecutivo 34136, rather than on a provision having the force of law, as required by the legal system.

The plaintiff has received payment of this incentive since 01 de noviembre de 2011 and continued to receive it at least through 3 de junio de 2019 (img. 88-91):

UNPROVEN FACTS.- The following are material to the decision in this case: 1.- That a legal basis exists for salary parity between the members of the Tribunal Ambiental Administrativo and the salaries of members of Tribunales in the Poder Judicial. 2. That annulment of the judicial-risk incentive has a direct impact on the defense and preservation of a healthy and ecologically balanced environment and violates the principle of non-regression (principio de no regresión) in environmental matters.

ARGUMENTS OF THE PLAINTIFF.- The State’s representative states that Ms. Alvarado Rojas works at the Tribunal Ambiental Administrativo, where she holds the position of Civil Service Professional 3. The representative indicates that, in response to a request submitted by the defendant, the Minister of Environment and Energy, through resolution N°R-DRH-AJ-266-2009, issued at 8:00 a.m. on October 13, 2011, approved in her favor an 18% incentive for Risk in the Exercise of the Judicial Function, which was granted through personnel action number 1111001965, effective November 1, 2011. The representative explains that, in resolution N°R-0179-2018-MINAE, issued at 1:00 p.m. on June 11, 2018, the Acting Minister of Environment and Energy declared that recognition of the incentive was injurious to the interests of the State (lesivo a los intereses del Estado) and referred the case file to the Procuraduría General de la República to institute an action seeking annulment of an act injurious to the public interest (proceso de lesividad).

After providing a general introduction regarding the scope of a declaration that an act is injurious to the public interest (lesividad), the representative states that, in this specific case, the effects of the act have continued over time because the incentive has been granted to the defendant from November 1, 2011 to the present. The representative therefore considers this case to fall within the second scenario contemplated in Article 34 of the CPCA, because, since its effects continue over time, the one-year period established in the Código Procesal Contencioso Administrativo for declaring the act injurious to the public interest has not yet elapsed, and its nullity may be declared only with prospective effect. Regarding the objective aspect, the representative argues that the act is substantially inconsistent with the legal system because the salary incentive for Risk in the Exercise of the Judicial Function was granted without a legal basis, based on the erroneous conclusion that officials of the Tribunal Ambiental Administrativo perform functions similar to those of employees of the Poder Judicial.

This conclusion was based on an interpretation of judgment N°1880-96, issued at 3:51 p.m. on April 24, 1996, in which the Sala Constitucional determined that the salaries of employees of the Tribunal Fiscal Administrativo had to be placed on an equal footing with those of the Poder Judicial. The representative notes that the difference between those employees, as well as those who work at the Tribunal Aduanero, and the officials in this case is that, in the former cases, a law expressly provides for salary parity (equiparación salarial). In support of this position, the representative cites judgment N°2012-3267 of the Sala Constitucional, issued at 4:01 p.m. on March 07, 2012, in which that body stated that “...Public Administrations are subject to limitations when granting certain salary benefits that lack support in statutory provisions.” The representative also cites resolution 6-2012-VI of the Sixth Section of this Court, as well as opinion number C-257-2015 of the Procuraduría.

The representative clarifies that, although Decreto Ejecutivo N°34136 of June 20, 2007, which is the Reglamento de Procedimiento del Tribunal Ambiental Administrativo, granted its members compensation equal to the salaries of the Higher Courts of the Poder Judicial, the disputed incentive was not granted on the basis of that Decreto. The representative further asserts that the salary parity provided for therein was repealed by Decreto Ejecutivo N°36035, “Reforma Reglamento de Procedimiento del Tribunal Ambiental Administrativo.” The representative states that, in Decreto N°34136, the Executive Branch exceeded its regulatory authority (potestad reglamentaria) by providing that the compensation of the members of the Tribunal Ambiental Administrativo had to be placed on an equal footing with the salaries of judges of the Higher Courts of the Poder Judicial, thereby exceeding the provisions of the Ley Orgánica del Ambiente.

Although that law does not regulate this issue, the existing gap could not be filled by means of a Decreto. The representative further maintains that the act whose nullity is alleged harms the public interest and the public treasury, and seeks a declaration that the aforementioned act is null and void.

ARGUMENTS OF THE DEFENDANT.- For her part, the defendant identifies problems in the administrative record (expediente administrativo) submitted, argues that she did not apply for recognition of the salary incentive for risk in the exercise of the adjudicative function (función jurisdiccional), but instead did so at the request of the Dirección de Recursos Humanos, and maintains that it has formed part of her salary since she began working at the Tribunal Ambiental Administrativo. She indicates that, although the incentive has an effective date of November 1, 2011, it was actually recognized as of September 16, 2011, when she was hired, as shown by personnel action 1111009065. She states that resolution N°R-0179-2018-MINAE, issued at 1:00 p.m. on June 11, 2018, in which the act was declared injurious to the public interest, was never served upon her and does not appear in the administrative record; therefore, in her view, it is an ineffective act.

She explains that recognition of the salary incentive is a vested legal situation (situación jurídica consolidada) that created subjective rights (derechos subjetivos) in good faith, which must be considered when determining the scope of the limitation periods for expiration (caducidad) and prescription (prescripción). She says that the State’s sole objection is that no law authorizes recognition of the incentive, but that the State fails to analyze the fact that Tribunal officials perform work similar to that performed by judicial officials. Regarding voto 2012-3267, issued by the Sala Constitucional and cited by the plaintiff, she states that the ruling concerns facts unrelated to this matter involving a double salary incentive. She asserts that the amounts corresponding to the incentive were duly budgeted and that the State has not established any harm to the public treasury. She argues that application of the provisions governing the institutional safeguards (garantías orgánicas) of the Poder Judicial is warranted by the nature and functions of the Tribunal Ambiental, which is independent and provides users with specialized administrative justice.

She adds that the incentive is not a privilege, just as it is not a privilege for employees of the Poder Judicial. She asserts that it constitutes a guarantee to the public that administrative justice is independent, competent, and adequately compensated; she reiterates the similarity of the functions and states that the Administrative Courts perform an adjudicative function. Consistent with this position, she notes that there is no justification for the salary differences between officials who administer justice in the Poder Judicial and those who do so in an administrative court. She also argued that the resolution declaring the act granting her the benefit injurious to the public interest was never served upon her, which, she asserted, is an indispensable requirement for allowing the claim to proceed. She raised the defenses (defensas) of defective filing of the claim, lack of legal entitlement, expiration, and prescription.

REQUIREMENTS FOR A DECLARATION THAT AN ACT IS INJURIOUS TO THE PUBLIC INTEREST.- In deciding cases similar to the matter now before the Court, other sections of the Tribunal Contencioso Administrativo have stated the following regarding the general parameters governing such a declaration (see, among others, the judgments issued by that section, numbers 73-2021-V, at 3:00 p.m. on August 17, 2021, 102-2021-V, at 1:23 p.m. on October 26, 2021, and, in particular, number 2025001885, at 11:49 a.m. on February 28, 2025):

“Such being the case, and since the purpose of these proceedings for a declaration of harmfulness is to analyze the validity of administrative acts having favorable content, it is necessary to establish briefly whether the various requirements imposed by the legal system for bringing proceedings of this nature have been met, given that the absence of any one of these elements would preclude and make it impossible to grant the relief sought in the complaint. It should be noted that the court must examine these requirements sua sponte, as they constitute essential elements of the action. Generally speaking, a declaration of harmfulness constitutes a judicial mechanism whereby the Administration seeks to set aside an act of its own which, in principle, produces an effect favorable to a third-party addressee. From that standpoint, in proceedings of this kind, harmfulness is subjective in nature, insofar as the Administration seeks the annulment of conduct that grants a right or, more generally, a beneficial legal position to a person.

Although what is analyzed is the validity of specific (rather than general) public conduct having favorable content, such review requires the participation of the addressee of that specific conduct so that the addressee may exercise the rights of defense and adversarial process with respect to claims seeking to alter the addressee’s legal position. This mechanism is codified in section 34 of the Code of Administrative Procedure, which establishes its prerequisites and procedural rules. It is also referenced, however, in section 173.6 in relation to section 183 of the General Law of Public Administration. From the standpoint of procedural requirements, subjective, objective, procedural, and temporal conditions are imposed. As to the subjective aspect, standing to bring the action is granted to the Administration that issued the challenged act, while the party with standing as defendant is the recipient of the effects of the conduct—that is, the person who obtains its benefits.

As to the objective aspect, a declaration of harmfulness constitutes a mechanism for legally eliminating final administrative acts of individual scope and favorable content that are substantially inconsistent with the legal system—that is, acts affected by some degree of invalidity, whether absolute or relative, in any of its forms (sections 128, 158, 165, and related provisions of the aforementioned General Law No. 6227). Accordingly, the Administration must declare that conduct harmful to the public interest, which must be determined through a series of internal actions by the Administration that are indispensable to bringing the action. Indeed, procedurally, the highest-ranking authority of the respective Public Administration must declare the act harmful, whether because it adversely affects economic, fiscal, or other interests arising from the public interest; for this purpose, that authority must have a supporting legal and technical opinion on which to base the determination.

Unlike other mechanisms for setting aside public conduct (such as the sua sponte annulment provided for in section 173 of the LGAP), this does not require a hearing for the affected third party, but only internal actions by the Administration intended to verify the existence of an express administrative decision issued by the highest-ranking authority indicating an intent to set aside the act. It is within the judicial proceedings that the addressee may present arguments in defense; therefore, the addressee’s lack of participation in the administrative stage concerning the declaration of harmfulness does not in any way impair the right to due process or administrative procedure. Now, when the act emanates from the State (see section 1 of the General Law of Public Administration)—that is, from the Central Administration—the action may be brought only by the Office of the Attorney General of the Republic (section 16 of Law No. 8508), upon the prior request of the highest-ranking authority and following an internal declaration of harmfulness detailing the grounds for that determination.

When the act emanates from a public entity, the rules governing judicial representation are those established in section 17 of that same code. As to the temporal dimension, the new procedural legislation establishes a period of one year, calculated from the business day following the act’s issuance (not its notification), within which the act must be declared harmful to the public interest at the administrative level, unless its effectiveness was conditioned upon compliance with a requirement established by the legal system or by the formal conduct itself that is sought to be declared harmful, pursuant to sections 141.1 and 145.1 of the General Law of Public Administration. The foregoing is subject to an exception where the act is affected by absolute nullity and produces continuing effects; in that event, under section 34.1 of the Code of Administrative Procedure, the internal declaration may be issued for as long as the effects of the act continue.

In that situation—an act affected by absolute nullity and producing continuing effects—the one-year period is calculated from the cessation of its effects, and any judgment declaring nullity shall do so solely for purposes of the act’s prospective annulment and inapplicability. Following that declaration (and not following the expiration of that initial one-year period), a period of one year is granted to bring the administrative-law action, as a strict forfeiture period, pursuant to section 39 of the Code of Administrative Procedure. Any exception to this procedural rule must be expressly established by procedural legislation.[…]

VII.Failure to comply with the temporal requirement for the internal declaration of harmfulness. With regard to the temporal element, it is important to note that section 34.1 of the CPCA establishes the time limits applicable to the stages of the proceeding under review. The provision states: “...1) When the Administration itself, as the issuer of an act declaring rights, seeks to bring an action for its annulment before the Administrative-Law Jurisdiction, the highest-ranking authority must first declare it harmful to public, economic, or any other interests. The maximum period for doing so shall be one year, calculated from the day following the day on which the act was issued, unless the act contains defects rendering it absolutely null and void, in which case such declaration may be made for as long as its effects continue…” (emphasis not in the original).

SUBJECTIVE, OBJECTIVE, AND PROCEDURAL REQUIREMENTS FOR AN ACTION TO DECLARE AN ADMINISTRATIVE ACT INJURIOUS TO THE PUBLIC INTEREST (LESIVIDAD) IN THIS CASE.- According to the proven facts, by official letter DM-350-2014, dated 03 de septiembre del 2014, the then Minister of Environment and Energy, Mr. Edgar Gutiérrez Espeleta, asked the Office of the Attorney General of the Republic, insofar as relevant, whether it was appropriate to grant the judicial-function risk incentive to the officials of the Tribunal Ambiental Administrativo and who would have standing to receive it. He further asked what would happen to payments already being made if the judicial-function risk incentive had been granted to officials of the Tribunal Ambiental Administrativo by means of an administrative decision. It has likewise been established that the PGR, in Opinion C-257-2015, dated 16 de septiembre del 2015, answered the inquiry and concluded that, absent a law establishing salary equivalence between members of the Tribunal Ambiental Administrativo and members of the Higher Courts of the Judiciary, the former could not be granted the salary components awarded to members of the judicial courts, including the risk incentive for the exercise of judicial functions.

It further stated that this incentive could not properly be recognized as a vested right, because it did not become a permanent component of the officials’ salaries but was instead subject to requirements or conditions—essentially, that their salaries and positions must have been legally made equivalent to the positions and salaries of the Judiciary—such that, if an employee did not meet the established conditions, payment of the incentive had to be denied. It added that, if such payment had been recognized by an administrative decision, it had to be terminated pursuant to Article 173 of the Ley General de la Administración Pública or Articles 10.5, 34, and 39.2 of the Código Procesal Contencioso Administrativo. Finally, the Court has verified that the Ministerio de Ambiente y Energía, based on the technical opinion issued by the Procuraduría General de la República, declared in decision R-0179-2018-MINAE, at 13:00 on 11 de junio del 2018, that the act recognizing Ms.

María Julia Alvarado Rojas’s entitlement to payment of the judicial-function risk incentive was injurious to the State’s economic interests. The foregoing demonstrates compliance with the subjective requirement and also with the procedural requirement, insofar as the record contains the legal and technical analyses upon which the administrative authority based its decision to resort to this form of ex officio revocation of favorable administrative conduct. In this regard, as to the active subjective requirement, the internal declaration of injuriousness to the public interest (declaratoria interna de lesividad) was issued by the head of the Ministerio de Ambiente y Energía. The action, moreover, is directed against the person who received the favorable effects of the challenged acts; consequently, there is likewise no deficiency concerning the passive subjective requirement. Regarding the objective aspect, the declaration of injuriousness must concern final acts having favorable content.

Because the challenged actions, both principal and related, concern the award of an additional judicial-risk salary payment recognized for the defendant in decision R-DRH-AJ-266-2011, at 08:00 hours on 13 de octubre del 2011, by the person then serving as head of the ministerial portfolio, the requirements established by the legal system are also satisfied. It is clear that this conduct, irrespective of whether it was valid, produced a beneficial effect for the defendant by granting her a subjective right consisting of a salary incentive. Thus, pursuant to the protection afforded by the doctrine of the irrevocability of one’s own acts (intangibilidad de actos propios), derived from Article 34 of the Constitución Política, its invalidation must be carried out in accordance with the procedure established by the legal system for such purposes, such as the mechanism provided for in Article 173 of the LGAP or, as in this case, through an action to declare an administrative act injurious to the public interest (acción de lesividad) (Art. 183 of that statute).

For the foregoing reasons, the subjective and procedural requirements established by the legal system for the action to declare an administrative act injurious to the public interest are deemed satisfied. The objective requirement will be examined in greater detail when reviewing the requested nullity. At this point, it should be noted that the administrative power to annul acts declaring subjective rights is exceptional in nature, and for that reason the legal system establishes a procedure intended to ensure that this power is not exercised arbitrarily. Therefore, when the nullity is not evident and manifest, the Ley General de la Administración Pública and the Código Procesal Contencioso Administrativo require the relevant Administration to institute “contentious-administrative proceedings to declare an act injurious to the public interest” (contencioso-administrativo de lesividad) in order to guarantee due process; it is in those proceedings that the party whose rights could ultimately be affected may participate and present a defense.

Accordingly, the fact that, in the administrative proceeding preceding the judicial proceeding, the affected party did not participate and was not notified of the declaration of injuriousness does not violate due process.

COMPLIANCE WITH THE TIME REQUIREMENT FOR THE INTERNAL DECLARATION OF INJURIOUSNESS TO THE PUBLIC INTEREST: Regarding the time requirement, it should be noted that subsection 1) of Article 34 of the Código Procesal Contencioso Administrativo establishes the time limits applicable to the stages of this proceeding:

“1) When the Administration itself, as the author of an act declaring rights, seeks its annulment before the Contentious-Administrative Jurisdiction, the highest-ranking superior authority must first declare it injurious to public, economic, or other interests. The maximum period for doing so shall be one year, calculated from the day following the date on which it was issued, unless the act contains defects resulting in absolute nullity (nulidad absoluta), in which case such declaration may be made for as long as its effects continue…”.

Counsel for the State argues that the acts challenged here have continuing effects (efectos continuados), insofar as they grant the defendant a salary incentive that has been paid to her periodically, which in turn means that the action has not become time-barred (caducidad). Regarding cases involving other officials of the Tribunal Ambiental Administrativo in the same situation as the plaintiff, the Sala Primera de la Corte has established the following line of precedent (decision number 01890–2024, at 10:40 hours on 19 de diciembre de 2024):

“This Court of Cassation disagrees with the ruling of the Tribunal Contencioso Administrativo, Sección V, for the reasons set forth below. In the judgment issued by this Chamber under decision number 000788-F-S1-2021, at 10:55 hrs. on 08 de abril del 2021, a situation analogous to the present dispute was addressed and decided. In that context, the following was held: “IV. On other occasions, this Chamber has distinguished between acts having continuing effects and acts having instantaneous effects (efecto instantáneo). The former are characteristic of legal relationships extending over time and arise when the act continuously affects an individual’s legal sphere, whether by creating, modifying, or terminating during that period the relationships or situations comprising that legal sphere. Acts having instantaneous effects, in contrast, are exhausted at a single moment, specifically the moment that positively or negatively alters the set of rights, powers, obligations, duties, and burdens borne by individuals.

In this regard, reference may be made to the decision at 10 hours 10 minutes on 23 de octubre de 2012, corresponding to decision number 1426-F-S1-2012. In the case under review, the personnel action modified the monetary amount that the plaintiff was to receive by granting him an increase for the exclusivity restriction component (rubro de prohibición), calculated as 65% of his base salary. That decision plainly affects the employee’s legal sphere month after month because, with each payment made to him by the Administration, the act once again produces its effects. This is a classic example of an administrative act having continuing effects. Thus, Article 34 subsection 1) of the CPCA provides: “When the Administration itself, as the author of an act declaring rights, seeks its annulment before the Contentious-Administrative Jurisdiction, the highest-ranking superior authority must first declare it injurious to public, economic, or other interests.

The maximum period for doing so shall be one year, calculated from the day following the date on which it was issued, unless the act contains defects resulting in absolute nullity, in which case such declaration may be made for as long as its effects continue. In the latter circumstance, the one-year period shall begin to run when its effects cease, and the judgment declaring nullity shall do so solely for purposes of its annulment and future inapplicability.” As established in the facts deemed proven, the personnel action appointing Mr. Ramírez Guier dates from 1 de julio de 2013. Membership in the Professional Association, an indispensable requirement for recognition of the exclusivity restriction, was never proven by the defendant. Thus, each month in which he received the payment constituted another improper payment affecting public finances. By official letter SRS-769-2015 of 4 de mayo de 2015, the Administration ordered the termination of the payment in question.

In other words, it was through this decision that the Administration terminated the effects of the administrative act recognizing that salary incentive; accordingly, it is from that point that the annual period established in Article 34 subsection 1), cited above, began to run. The Concejo Municipal issued the declaration of injuriousness on 14 de julio de 2015, at ordinary session 272. A simple arithmetic calculation therefore makes clear that the period mandated by Article 37.1 of the CPCA had not yet elapsed between the termination of the act’s effects on 4 de mayo de 2015 and the declaration of injuriousness on 14 de julio de 2015. The appellant is therefore correct, and the action is not time-barred; consequently, the claim cannot be declared inadmissible.” (In this regard, see this Chamber’s decisions number 000788-F-S1-2021, at 10:55 hrs. on 08 de abril del 2021. https://nexuspj.poder-judicial.go.cr/document/sen-1-0004-1034473 and No. 10-F-S1-2022, at 10:20 hrs. on 13 de enero del 2022. https://nexuspj.poder-judicial.go.cr/document/sen-1-0004-1071319).

Based on that ruling, its application to this case is warranted because this Chamber considers decision No. R-DRH-AJ-143-2009, at 08:30 hours on 30 de marzo del 2008, issued by the Ministro de Ambiente y Energía, which approved in favor of the defendant the 18% Risk in the Exercise of Judicial Functions incentive and was implemented through personnel action No. 509003257, dated 1° de mayo de 2009, to be an act having continuing effects. This is because such recognition entails an annual expenditure by the Administration and therefore represents a sequential situation that, month after month, affects the salary amount by increasing her income, an effect that will necessarily persist over time and repeatedly affect the defendant’s legal sphere. Accordingly, the asserted ground of appeal is upheld.” The Sala Primera having already determined that, in cases such as the present one, the temporal requirement (supuesto temporal) mandated by the legal system is indeed satisfied, this Chamber considers it pointless to maintain a position contrary to that already expressed by the Superior Court.

This position entails rejecting the defense of forfeiture (caducidad) raised by the defendant, because the period for declaring the act harmful to the public interest (lesivo), for purposes of its future inapplicability, would begin to run upon the cessation of its effects, which had not occurred when the complaint was filed, since it has been established that she continued to receive the incentive at least until 3 de junio de 2019. Even if the period is calculated from the date on which the act whose annulment is sought was declared harmful to the public interest—which occurred in resolution R-0179-2018-MINAE, del 11 de junio del 2018—to the date on which the complaint was filed (11 de marzo del 2019), the one-year period likewise did not elapse between those two points in time; therefore, this defense must be rejected. With regard to the statute of limitations (prescripción) asserted as a defense by the respondent, the Court finds that this defense is inadmissible because this is a proceeding for a declaration that an act is harmful to the public interest (proceso de lesividad), in which the action is extinguished by forfeiture, pursuant to artículo 34 del Código Procesal Contencioso Administrativo.

ANNULMENT OF THE RISK INCENTIVE FOR THE PERFORMANCE OF JUDICIAL DUTIES GRANTED TO THE RESPONDENT:— Based on the evidence in the case file (expediente), the Court has established that, in response to an administrative claim filed by the respondent Alvarado Rojas, through resolution R-DRH-AJ-266-2011, de las 08:00 horas del 13 de octubre del 2011, the then head of Ambiente y Energía decided to grant her the “… salary supplement incentive (incentivo del Plus Salarial) known as Risk in the Performance of Judicial Duties, amounting to 18% as applicable to her position.” This was based on Voto de la Sala Constitucional N°1880-96, de las 15:51 horas del 24 de abril de 1996, which granted that benefit to the members of the Tribunal Fiscal Administrativo. Nevertheless, after examining that ruling, the Court concludes that the then Acting Minister of Ambiente y Energía incorrectly interpreted the decision issued by the Sala Constitucional in order to justify granting the incentive.

In the judgment at issue—número 1880-96, de las 15:51 horas del 24 de abril de 1996—the Sala Constitucional decided an amparo proceeding (recurso de amparo) brought by public servants of the Tribunal Fiscal Administrativo, in which they alleged a violation of their right of petition recognized in precept 27 of the Constitución Política. At that time, they asserted that they had applied to the Dirección General del Servicio Civil for salary parity (equiparación salarial) under the terms established by numeral 161 del Código Tributario. In that matter, the Tribunal Constitucional found that the salary parity in question arose from a statutory mandate resulting from the amendment of the aforementioned artículo 161 del Código Tributario, and that the Administration—in this case, the Dirección General del Servicio Civil—was failing to comply with the law, thereby also infringing the petitioners’ right to legal certainty (seguridad jurídica), as well as their right to receive salary parity under the statutory provision that established that the duties entrusted to the public servants of the Tribunal Fiscal Administrativo are substantively similar to those of judicial employees and that the salary equality established by the legislature must be restored.

Accordingly, the Tribunal Constitucional ordered that the claim of the petitioners be resolved so that the parity process could be completed, as required by law. Thus, the Sala Constitucional’s ruling, in which it noted the Administration’s resistance to addressing the application submitted by the public servants of the Tribunal Fiscal Administrativo, was based on the fact that the legislature had already recognized, in numeral 161 del Código Tributario, their right to receive remuneration similar to that received by members of multi-member courts (tribunales colegiados) within the Poder Judicial. Therefore, although the judgment states that “the officials of the Tribunal Fiscal Administrativo must receive salaries or wages equal to those of equivalent positions in certain courts of the Poder Judicial; that is, both groups must receive the same treatment with respect to remuneration for their work,” it also indicated that this was so because the law presumes that similar duties are performed within those bodies.

Consequently, that judgment granted the amparo proceeding because the Sala found that, in this case—that of the members of the Tribunal Fiscal Administrativo—the Dirección General de Servicio Civil was failing to comply with a statutory provision recognizing salary parity. Nevertheless, it cannot be concluded from the foregoing that entitlement to the aforementioned salary component (componente salarial) automatically extends to all officials serving on administrative tribunals, because salary parity covers only those positions for which it is expressly recognized by a provision having the force of law. This is so because public employment relationships (relaciones de empleo público) are governed by the principle of legality (principio de legalidad), which imposes limitations on the elements comprising the remuneration of public servants. In this regard, artículo 48 del Estatuto del Servicio Civil provides:

“The salaries of officials and employees protected by this law shall be governed by the following rules:

  • a)No employee or official shall earn a salary lower than the minimum applicable to the position held.
  • b)The salaries of public servants of the Poder Ejecutivo shall be determined by a Ley de Salarios establishing the minimum, intermediate, and maximum amounts corresponding to each employment category.
  • c)In setting salaries, consideration shall be given to fiscal conditions, the characteristics of each class of work, the cost of living in the different regions, the salaries prevailing in private companies for comparable positions, and the other factors stipulated by the Código de Trabajo.
  • d)Within the minimum and maximum amounts referred to in subsection b), the respective supervisors may approve salary increases based on factors such as efficiency, seniority, conduct, abilities, and other qualities identified through the periodic performance evaluation of their public servants, all subject to the provisions established for that purpose by the Ley de Salarios. Before granting such increases, the heads of the various administrative personnel sections must obtain the approval of their hierarchical supervisor; such increases shall be subject to subsection e) of this same article; and e) The Tesorería Nacional is prohibited from issuing payment orders in favor of employees or officials for amounts other than the minimum amounts established in the Presupuesto or Ley de Salarios; and, in the case of the preceding subsection, the increase shall not take effect unless it is included in the Ley de Presupuesto Ordinario or in an extraordinary budget. The Dirección General de Servicio Civil shall notify the Tesorería Nacional of increases in the salaries of public servants.” Along the same lines, the Ley de Salarios de la Administración Pública N°2166 de 09 de octubre de 1957, in force for the matter under consideration, states in artículo 1:

“This law is enacted to ensure the efficiency of the Administration and shall constitute the remuneration system for all classes of positions classified in the descriptive position manual, as provided in capítulo X del Estatuto del Servicio Civil.” It follows from the provisions quoted above that, in public employment relationships, the various items comprising salary, or that must be considered in determining it as a whole, must be defined by law. Accordingly, the only salary components that may validly be recognized are those arising from a provision having the force of law or those contained in a higher-ranking provision. In this regard, the Sala Constitucional, in voto N°2012-003267 de las 16:01 horas del 07 de marzo del 2012, when reviewing the constitutionality of artículo 63 del reglamento Autónomo de Servicio del Ministerio de Hacienda, stated:

“III.- On the merits. A.- Regarding the public employment relationship (relación de empleo público).- Since issuing judgment No. 1992-01696, this Constitutional Chamber has held, on numerous occasions, that the public employment relationship is a public-law or statutory relationship (relación de derecho público o estatutaria) that has inherent limitations regarding the application of ordinary labor law, such that not all employer-granted benefits are permissible. Likewise, the Political Constitution of 1949 marks the point from which the public employment regime (régimen laboral público) took effect within the legal system, entailing strict adherence to Articles 11, 191 and 192 of the Political Constitution. Before 1949, the Political Constitution established nothing regarding the employment relationship between the State and public servants. For its part, in decision No. 2000-4453, the Chamber more clearly established the limitations on collective bargaining (negociación colectiva) for officials who perform public administration functions, as distinguished from those who do not, and the possibility for the latter to have access to these collective-bargaining mechanisms.

In this regard, the State and the public official are subject to a special relationship of subordination (relación de sujeción especial), which places the public official, within the employment relationship, in a situation very different from that of an employee in an ordinary employment relationship; in turn, the statutory relationship has particular implications for the Public Administration. In a statutory relationship, the State holds a position of preeminence over the public official, which binds them throughout the entire public employment relationship; that relationship is, in turn, governed by a public-law legal framework (...). Notwithstanding the foregoing, insofar as it is recognized that each Public Administration may unilaterally establish specific employee benefits and conditions, the Chamber must examine more deeply the reasons why such benefits must, at a minimum, be authorized under the body of legality and constitutionality (bloque de legalidad y de constitucionalidad); that is, they must have a legitimate basis consistent with the law or be granted proportionately to the purposes pursued by the public service being provided.

(...). Now, once it has been determined that the service relationship (relación de servicio) between the Public Administration and its public servants is statutory, the impact that unilaterally granted benefits have on public resources cannot be disregarded, particularly when such benefits are often granted by individual sectors and in isolation, unless approved through a legal provision. It is clear to the Chamber that many administrative measures affect public finances, especially when they grant benefits, thereby becoming a means of circumventing a fundamental principle of public law: the principle of statutory reservation (principio de reserva de ley). In this regard, certain obligations imposed on the Public Treasury must be assessed not only from an administrative perspective but also from the standpoint of State economic policy, insofar as they place a burden on public resources and the legislature plays a central role.

Accordingly, it is important to note that, on this issue, the Chamber modifies its position, with consequences for the precedents cited supra; that is, Public Administrations are subject to limitations when granting certain salary benefits that lack support in statutory law. B- Regarding the principle of statutory reservation.- There is no doubt that, under the principle of legality (principio de legalidad), the Public Administration may do only what has previously been authorized by a legal provision of that nature and, consequently, may establish and regulate only what a statutory provision permits. Likewise, there are certain matters that only the legislature may properly regulate, because the statute involved is both formally and substantively legislative and satisfies the requirements governing its enactment in accordance with the democratic principle; consequently, the Executive Branch may not regulate such matters autonomously.

As previously held by this Chamber in judgment No. 1992-03550: “Third, that not even in executive regulations, much less in autonomous regulations or other lower-ranking rules or acts, could the law validly delegate the determination of regulations or restrictions that only the law itself was empowered to impose (...)” For this reason, the regulation of fundamental rights is reserved to statutes. Although the General Law of Public Administration (Ley General de la Administración Pública) authorizes and develops regulatory authority (potestad reglamentaria), the fact remains that granting employment benefits consisting of leave for officials to receive a salary without working effectively contravenes constitutional and statutory principles and rights, because it reverses the hierarchy of norms. The other issue is that the Civil Service Statute (Estatuto de Servicio Civil) governs the vacation leave of public officials subject to the civil service regime; however, in this Court’s view, a regulatory provision may not expand a right governed by statute by using another legal institution that ultimately grants similar benefits.

In this regard, a lower-ranking provision could not modify statutory provisions establishing an orderly method for administering and disbursing public resources, much less where it affects the principle arising from Article 140, subsection 7), of the Political Constitution, which requires the President and the Government Minister to direct the expenditure of national revenues in accordance with the laws. It is therefore accepted that Public Administrations are governed by the principle of legality, which applies even more strictly under the principle of financial legality (principio de legalidad financiera), given that public funds are involved. This principle of legality is manifested in the management, administration, allocation, and custody of public resources. Accordingly, through Law No. 8131 of 18 de septiembre de 2001, the Public Financial Administration and Public Budgets Law (Ley de Administración Financiera y Presupuestos Públicos), the legislature sets forth in Article 5 the various principles, including the principle of financial management (principio de gestión financiera).

The provision defines it as follows: “For purposes of the preceding article, the following budgetary principles shall be observed: a)…b) Principle of financial management. The administration of the public sector’s financial resources shall be directed toward society’s general interests, in accordance with the principles of economy, effectiveness, and efficiency, and in full compliance with the law (...).” In this regard, the legislature incorporated into the legal system and developed within the Public Administration the principle of financial legality, fully consistent with Article 140, subsection 7), of the Political Constitution, thereby precluding the unauthorized use of public resources based solely on the discretion of the Public Administration through an Autonomous Regulation (Reglamento Autónomo) or a public-law act not expressly authorized by statute. The legislature eliminated all doubt concerning the scope of the principle by categorically requiring full compliance with the law.

Likewise, Article 107, in referring to the principle of legality, provides: “Administrative acts and contracts issued in matters of financial administration must substantially conform to the legal system, according to the hierarchical order of its sources. The legality of the acts and operations of public bodies and entities subject to this law shall be presumed, but evidence to the contrary shall be admissible.” Consequently, they must substantially conform to the legal system, so the Public Administration does not have unfettered discretion to create sources of expenditure; on the contrary, statutory authorization is required. It is equally important to note that the financial obligations of the Public Treasury may arise from statute; likewise, they may arise from judicial decisions (Articles 122 and 153 of the Political Constitution), and from administrative contracts and acts when they entail obligations based on certain manifestations of the State’s will.

It is important to clarify, however, that these manifestations cannot be understood from a private civil-law or labor-law perspective, not only because of what was stated supra, but also because they concern contractual arrangements whose source lies precisely in statute or for which statute establishes the mechanisms for creating such financial obligations.” In the matter under review, the Court has deemed it a proven fact that, in decision R-DRH-AJ-266-2011, the Ministerio de Ambiente y Energía granted Ms. María Julia Alvarado Rojas the judicial-function risk allowance (incentivo del riesgo de la función judicial), an action based on Constitutional Chamber ruling 1880-96, which, as stated above, did not have the effect of extending the benefit established in section 161 of the Tax Code (Código Tributario) for the members of the Tribunal Fiscal Administrativo to other similar bodies within the Public Administration, because what was determined there was the respondent’s omission in complying with the statute that established the allowance.

Thus, a benefit of this nature could be established only by statute, without prejudice, of course, to its recognition in judicial or administrative proceedings—and even to a determination that its payment is mandatory—when this results from applying the statutory provision that created the benefit. That is not the case here, even though payment of the allowance known as Judicial-Function Risk (Riesgo de la Función Judicial), amounting to 18%, clearly affects public funds. The Court considers that a grant of this nature, which affects the Public Treasury, must be expressly authorized by statute. Accordingly, for persons serving on the Tribunal Administrativo Ambiental to receive that salary allowance (incentivo salarial), the legislature must approve the expenditure after assessing whether the equal treatment is reasonable and whether it has a proper basis. Therefore, the respondent’s assertions that her work as a member of an administrative tribunal is equivalent to the functions performed by a judicial body and is similar to the work carried out by the Tribunal Fiscal Administrativo are irrelevant in this case, because her arguments cannot be accepted given that the underlying basis of decision R-DRH-AJ-266-2011 is not supported by a statute establishing such equivalence and authorizing payment.

Furthermore, the respondent contends that the harmfulness proceedings (vía de lesividad) violate the principle of non-regression in environmental matters (principio de no regresión en materia ambiental). The Court does not accept that contention, however, because the record does not demonstrate how annulment of the judicial-risk allowance directly affects the defense and preservation of a healthy and ecologically balanced environment to such an extent that its elimination would violate that principle. Although this Body understands that the compensation granted to public servants may affect the quality of their performance, those considerations must be substantiated before the appropriate authority so that salary components ensuring the provision of excellent services by officials may be recognized by statute. Furthermore, the arguments that the declaration of harmfulness (declaratoria de lesividad) violates the principle of non-regression in labor matters (principio de no regresión en materia laboral) are likewise without merit, because that principle clearly protects validly acquired rights, which are not present here. As stated, the circumstances that led to the granting of the judicial-risk allowance to the respondent lack statutory support, an indispensable requirement for its validity.

EXCEPTIONS.— In light of the foregoing recitals, the appropriate course is to reject the defenses of expiration (caducidad), statute of limitations (prescripción), and lack of legal entitlement (falta de derecho), whereupon resolution R-DRH-AJ-266-2011 of 8:00 hours on 13 de octubre de 2011 and its related acts should be declared null and void, and the Risk in the Exercise of the Judicial Function incentive (incentivo de Riesgo en el Ejercicio de la Función Judicial) granted to the respondent should be declared immediately inapplicable, solely with prospective effect.

COSTS.— Pursuant to Article 193 of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo), attorneys’ fees and procedural costs (costas personales y procesales) constitute a burden imposed on the losing party by virtue of having lost, and may be waived only when, in the Court’s judgment, there was sufficient cause to litigate, or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In the case under consideration, this Collegiate Body finds that the respondent had sufficient cause to oppose the claim, since this proceeding is precisely the only means afforded to her by the legal system to exercise her right of defense, as the law does not provide for her participation in the stage involving the administrative declaration that an act is detrimental to the public interest (declaratoria de lesividad); moreover, under the principle of legitimate expectations (principio de confianza legítima), the respondent had grounds to reasonably conclude that she was entitled to receive the judicial-risk incentive, not only because the legal system grants it to public servants of administrative bodies similar to the one of which she is a member, but also because her entitlement was expressly recognized by the head of the Ministerio de Ambiente y Energía.

POR TANTO

The defenses of expiration, statute of limitations, and lack of legal entitlement are rejected. The action seeking annulment of an administrative act as detrimental to the public interest (demanda de lesividad) filed by the STATE against MARÍA JULIA ALVARADO ROJAS is granted. Resolution R-DRH-AJ-266-2011 of 8:00 hours on 13 de octubre de 2011, as well as its related acts, is annulled, and it is ordered that, once this judgment becomes final, the Risk in the Exercise of the Judicial Function incentive granted to the respondent shall be inapplicable solely with prospective effect. MARIA JULIA ALVARADO ROJAS N° 2025006784 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las quince horas con veintitres minutos del ocho de julio del dos mil veinticinco.- Proceso de lesividad planteado por el ESTADO, representado por la procuradora Ana Vanessa Mora Carvajal (img. 16 de la carpeta), contra la señora MARÍA JULIA ALVARADO ROJAS, cédula 02-0560-0680, representada por sus apoderadas especiales judiciales Sonia Madrigal Fernández, carné 3250 y Noemy Zulay Linkemer Fonseca, carné 3464 (img. 136).

CONSIDERANDO:

ACTUACIONES PROCESALES.- De relevancia para la resolución del presente proceso se tienen las siguientes:

Por escrito presentado ante el Tribunal Contencioso Administrativo y Civil de Hacienda el 11 de marzo del 2019, el Estado planteó demanda ordinaria de lesividad contra la señora María Julia Alvarado Rojas, y con base en los hechos que expuso y fundamentos de derecho alegados, solicitó que en sentencia se declarara (img. 2-14. Estas pretensiones no fueron modificadas ni aclaradas en la audiencia preliminar):

"a. La nulidad absoluta de la resolución N.º R-DRH-AJ-266-2011 de las 8:00 horas del 13 de octubre de 2011 del Ministerio de Ambiente y Energía; y sus actos conexos.

b. La inaplicabilidad inmediata del incentivo de Riesgo en el Ejercicio de la Función Judicial, otorgado en la resolución N.º R-DRH-AJ-266-2011 de las 8:00 horas del 13 de octubre de 2011 del Ministerio de Ambiente y Energía y sus actos conexos.

c. Se condene a la parte demandada al pago de ambas costas y las sumas que estas generen desde su exigibilidad y hasta su efectivo pago".

En resolución de las 13:29 horas del 21 de febrero del 2019, se dio traslado de la demanda a la persona accionada (img. 17-19).

Mediante escrito presentado ante el Tribunal el 3 de abril del 2019, la parte demandada contestó negativamente la demanda y formuló las defensas de falta de derecho, presentación defectuosa de la demanda, caducidad y prescripción (img. 23-42).

La audiencia preliminar se llevó a cabo el 2 de julio del 2019. En ese acto se concedió audiencia por escrito a la parte demandada para que se refiriera al expediente administrativo y se fijaron las pretensiones según los establecido en el escrito de demanda. Asimismo, mediante resolución número 1130-2019, la persona juzgadora de trámite declaró sin lugar la defensa de defectos formales de la demanda y dejó las de caducidad y prescripción para ser conocidas en la sentencia de fondo, por no ser evidentes y manifiestas. Posteriormente fue admitida la prueba documental y se rechazó la prueba testimonial ofrecida. No se escucharon conclusiones orales, sino que las mismas fueron recibidas por escritos del 16 de julio de 2019 (img. 132-135, 147-157, 158-177 y respaldo de la audiencia oral).

Conforme al proceso de implementación del rediseño del Tribunal Contencioso Administrativo y Civil de Hacienda propuesto por la Dirección de Planificación del Poder Judicial y aprobado por el Consejo Superior, según los acuerdos números XXVIII de la Sesión N° 84-2021 del 28 de setiembre de 2021 y XXXIX de la Sesión N° 95-2021 del 04 de noviembre de 2021, se determinaron los criterios de distribución del circulante de los procesos pendientes de fallo, conforme a los cuales la Coordinación del Tribunal ejecutó a partir del diecisiete de julio de 2023 la reasignación de una gran cantidad de expedientes en el mismo momento, incluido este de Puro Derecho que fue turnado al juzgador Conejo Cantillo, por lo que se procede a resolver conforme a las políticas de prioridad establecidas por la Corte Plena (constancia img. 181).

En los procedimientos se han observado las prescripciones de rigor y no se perciben vicios u omisiones susceptibles de generar nulidad o indefensión a las partes. Redacta el juez Conejo Cantillo el voto afirmativo de los jueces Irías Obando y Díaz Anchía.

HECHOS PROBADOS.- De importancia para la resolución del presente asunto, se tienen como debidamente acreditados los siguientes, por encontrar sustento en los elementos de convicción que en su apoyo se citan:

El 16 de agosto del 2011, la actora gestionó ante el Departamento de Recursos Humanos del Ministerio de Ambiente y Energía (img. 96):

“Mediante la presente le solicito de la manera más atenta se sirva realizar las gestiones pertinentes para que se me otorgue el incentivo del 18% correspondiente al reconocimiento al ejercicio de la función judicial.

Lo anterior dado que a partir del próximo 16 de setiembre iniciaré funciones en el Tribunal Ambiental Administrativo”.

La señora María Julia Alvarado Rojas entró a laborar como funcionaria del Ministerio de Ambiente y Energía, en el cargo “Profesional de Servicio Civil 1-A”, puesto número 357532, en el Tribunal Ambiental Administrativo, en fecha 16 de septiembre de 2011 (img. 97, 100).

En resolución número R-DRH-AJ-266-2011, de las 08:00 horas del 13 de octubre del 2011, la entonces Ministra de Ambiente y Energía a.i., Lorena Guevara Fernández, resolvió (img. 97-99):

“… se acoge el reclamo administrativo interpuesto por María Julia Alvarado Rojas […], en lo que respecta al incentivo del Plus Salarial denominado Riesgo en el Ejercicio de la Función Judicial, de un 18% correspondiente de acuerdo a su cargo; por lo que se ordena al Departamento de Recursos Humanos iniciar los trámites administrativos correspondientes a efectos de que se proceda al reconocimiento de manera retroactiva a partir del momento de presentación del reclamo”.

Esta decisión se tomó con fundamento en la resolución de la Sala Constitucional número 1880-96, de las 15:51 horas del 24 de abril de 1996, que otorgó dicho beneficio a los miembros del Tribunal Fiscal Administrativo.

Mediante oficio DM-350-2014, del 03 de septiembre del 2014, el entonces Ministro de Ambiente y Energía, Edgar Gutiérrez Espeleta, consultó la Procuraduría General de la República lo siguiente (img. 111-112):

“1. ¿Es procedente conceder el incentivo de riesgo del ejercicio de la función judicial a los funcionarios del Tribunal Ambiental Administrativo? En el caso positivo, quiénes tienen la legitimación para ser beneficiados?

2. En caso de que vía resolución administrativa se haya concedido el incentivo del riesgo de la función judicial a los funcionarios del Tribunal Ambiental Administrativo, ¿qué sucede con los casos que actualmente se le está cancelando?

3. Al finalizar el plazo de 06 años por los que se nombra a los tres miembros del Tribunal Ambiental Administrativo o en caso de ser removidos antes de que finalice el período, la Administración Pública debe cancelar los rubros por concepto de preaviso y cesantía?”.

En el Dictamen C-257-2015, de 16 de septiembre del 2015, la Procuraduría General de la República atendió la consulta planteada por el Ministro de Ambiente y Energía mediante oficio DM-350-2014, referido en el hecho anterior, y dictaminó (img 113-126):

“Si no hay una ley que establezca la equiparación salarial de los miembros del Tribunal Ambiental Administrativo con los miembros de los Tribunales Superiores del Poder Judicial, no es posible reconocer a los miembros del Tribunal Ambiental Administrativo, los rubros salariales que se reconocen a los integrantes de los Tribunales del Poder Judicial, incluido el incentivo de riesgo por el ejercicio de la función jurisdiccional. No es procedente que el Ministerio de Ambiente y Energía reconozca el incentivo de riesgo por el ejercicio de la función judicial a los funcionarios del Tribunal Ambiental Administrativo como un derecho adquirido, toda vez que, el mismo no ingresa al salario de los funcionarios de forma permanente sino que el mismo está sujeto a requisitos o condiciones como lo sería para el caso de los Tribunales Administrativos que los salarios y puestos de sus funciones sean equiparadas a los puestos y salarios del Poder Judicial, de manera que si el servidor no cumple con las condiciones establecidas, el pago del incentivo debe ser rechazado y en caso de que se haya reconocido mediante resolución administrativa, como lo es el objeto de consulta, el mismo debe ser cesado.

Si el reconocimiento del sobresueldo se realizó por medio de resolución administrativa, para suprimirlo es necesario que la Administración siga el Procedimiento previsto en el artículo 173 de la Ley General de la Administración Pública; o bien en los artículos 10.5, 34 y 39.2 del Código Procesal Contencioso Administrativo, según corresponda”.

En resolución R-0179-2018-MINAE, de las 13:00 del 11 de junio del 2018, el Ministerio de Ambiente y Energía resolvió (img. 127-130):

"PRIMERO: Que al amparo de todas las consideraciones de hecho y de Derecho [sic] que anteceden la presente resolución, se declara el acto de reconocimiento al pago de incentivo de riesgo del ejercicio de la función judicial, a la señora María Julia Alvarado Rojas, como un acto lesivo a los intereses económicos del Estado".

Esta decisión se justificó por considerar que dicho acto se fundamentó en una resolución administrativa y ésta a su vez, en el Decreto Ejecutivo 34136, y no en una disposición con rango de ley, como lo exigía el ordenamiento jurídico.

Que la actora ha recibido el pago de este incentivo desde el 01 de noviembre de 2011 y continuaba recibiéndolo al menos hasta el 3 de junio de 2019 (img. 88-91):

HECHOS NO PROBADOS.- Importantes en la decisión de este caso, se tienen: 1.- Que exista fundamento legal para la equiparación salarial de los miembros del Tribunal Ambiental Administrativo con los salarios de quienes integran Tribunales en el Poder Judicial. 2. Que la anulación del incentivo por riesgo judicial tenga incidencia directa en la defensa y preservación de un ambiente sano y ecológicamente equilibrado y vulnere el principio de no regresión en materia ambiental.

ARGUMENTOS DE LA PARTE ACTORA.- La representación del Estado manifiesta que la señora Alvarado Rojas labora en el Tribunal Ambiental Administrativo, donde ocupa el cargo de Profesional Servicio Civil 3. Indica que con ocasión de una solicitud planteada por la accionada, el Ministro de Ambiente y Energía, mediante resolución N°R-DRH-AJ-266-2009, de las 8:00 horas del 13 de octubre de 2011, aprobó a favor de ésta un incentivo de 18% por Riesgo en el Ejercicio de la Función Judicial, el cual fue otorgado por acción de personal número 1111001965, a partir del 1 de noviembre del 2011. Expone que en resolución N°R-0179-2018-MINAE, de las 13:00 horas del 11 de junio del 2018, la Ministra a.i. de Ambiente y Energía, declaró lesivo a los intereses del Estado el reconocimiento del incentivo y remitió los autos a la Procuraduría General de la República para interponer el proceso de lesividad. Después de hacer una introducción general sobre los alcances de la lesividad, señala que se trata en el caso concreto de un acto cuyos efectos han perdurado en el tiempo por cuanto el incentivo se ha venido otorgando a la demandada desde el 1° de noviembre de 2011 hasta la actualidad, motivo por el cual estima que nos encontramos en el segundo supuesto del artículo 34 del CPCA, pues persistiendo sus efectos en el tiempo, el plazo de un año dispuesto en el Código Procesal Contencioso Administrativo para acordar la lesividad aún no ha transcurrido, siendo que su nulidad sólo podrá ser declarada para efectos futuros.

En lo que concierne al aspecto objetivo, aduce que el acto es sustancialmente disconforme con el ordenamiento jurídico, ya que el incentivo salarial de Riesgo en el Ejercicio de la Función Judicial fue concedido sin fundamento legal, al concluirse de forma errada que los funcionarios del Tribunal Ambiental Administrativo realizan funciones similares a los servidores del Poder Judicial. Lo anterior con fundamento en una interpretación de la sentencia N°1880-96 de las 15:51 horas del 24 de abril de 1996, en la cual la Sala Constitucional determinó que el salario de los servidores del Tribunal Fiscal Administrativo debía equipararse con los del Poder Judicial. Apunta que la diferencia con respecto a éstos, así como a los que laboran en el Tribunal Aduanero, es que en estos casos sí existe una ley que expresamente dispone la equiparación salarial. En apoyo de su tesis, cita la sentencia de la Sala Constitucional N°2012-3267 de las 16:01 horas del 07 de marzo del 2012, en la cual dicho Órgano señaló que "...las Administraciones Públicas tienen limitaciones para otorgar ciertos beneficios salariales que no encuentran apoyo en la normativa legal".

Cita además la resolución 6-2012-VI, de la sección sexta de este Tribunal, así como el dictamen de la Procuraduría número C-257-2015. Aclara que si bien es cierto en el Decreto Ejecutivo N°34136 del 20 de junio del 2007, que es el Reglamento de Procedimiento del Tribunal Ambiental Administrativo otorgaba a sus integrantes una retribución igual al sueldo de los Tribunales Superiores del Poder Judicial, alega que el incentivo cuestionado no fue concedido con base en dicho Decreto, así como que la equiparación salarial que éste contenía fue derogada por el Decreto Ejecutivo N°36035 "Reforma Reglamento de Procedimiento del Tribunal Ambiental Administrativo". Apunta que el Poder Ejecutivo excedió su potestad reglamentaria en el Decreto N°34136 al establecer que la retribución de los integrantes del Tribunal Ambiental Administrativo debía equipararse al sueldo de los jueces de Tribunales Superiores del Poder Judicial, excediendo de este modo las disposiciones de la Ley Orgánica del Ambiente, la cual, si bien no regula este tema, no podía, por medio de un Decreto, suplir el vacío existente. Sostiene además, que el acto cuya nulidad se acusa, lesiona el interés y el erario público, reclamando la declaratoria de nulidad del acto mencionado.

ARGUMENTOS DE LA PARTE ACCIONADA.- Por su parte, la demandada señala problemas en el expediente administrativo aportado, aduce que ella no gestionó el reconocimiento del incentivo salarial de riesgo en ejercicio de la función jurisdiccional, sino que lo hizo a petición de la Dirección de Recursos Humanos y sostiene que éste forma parte de su salario desde que ingresó a laborar al Tribunal Ambiental Administrativo. Indica que si bien el incentivo tiene fecha de rige 1 de noviembre de 2011, en realidad el reconocimiento se hizo desde el 16 de septiembre de 2011 que fue contratada, según se desprende de la acción de personal 1111009065. Señala que la resolución N°R-0179-2018-MINAE, de las 13:00 horas del 11 de junio del 2018, en la cual fue declarada la lesividad, nunca le fue notificada ni aparece en el expediente administrativo, por lo cual, según su criterio, se trata de un acto ineficaz.

Expone que el reconocimiento del incentivo salarial es una situación jurídica consolidada que creó derechos subjetivos de buena fe, lo cual debe valorarse para efectos de delimitar el ámbito de caducidad y prescripción. Dice que el único reproche formulado por el Estado es que no existe una ley que autorice el reconocimiento del incentivo, pero omite analizar que los funcionarios del Tribunal realizan labores similares a la llevada a cabo por funcionarios judiciales. En relación con el voto 2012-3267, emitido por la Sala Constitucional y citado por la parte actora, señala que ese fallo se refiere a hechos ajenos al presente asunto, relacionados con un doble incentivo salarial. Manifiesta que los rubros correspondientes al incentivo fueron oportunamente presupuestados, sin acreditar cuál es el daño al erario público. Alega que la aplicación de las disposiciones que regulan las garantías orgánicas del Poder Judicial, obedece a la naturaleza y funciones del Tribunal Ambiental, el cual es independiente y otorga justicia administrativa especializada a los usuarios.

Añade que el incentivo no es un privilegio, como no lo es tampoco para los servidores del Poder Judicial. Afirma que se trata de una garantía para los habitantes de que la justicia administrativa es independiente e idónea y adecuadamente remunerada, e insiste en la similitud de las funciones y señala que los Tribunales Administrativos realizan una función jurisdiccional. En línea con esta tesis, apunta que no se justifica la existencia de las diferencias salariales entre los funcionarios que administran justicia en el Poder Judicial y los que lo hacen desde un tribunal administrativo. También adujo que la resolución que acordó la lesividad del acto que le concedió el beneficio nunca le fue notificada, lo cual, según afirmó, es un requisito indispensable para darle curso a la demanda. Planteó las defensas de defectuosa presentación de la demanda, falta de derecho, caducidad y prescripción.

PRESUPUESTOS DE LA DECLARATORIA DE LESIVIDAD.- Al resolver casos similares al que ahora se conoce, otras secciones del Tribunal Contencioso Administrativo, han indicado lo siguiente sobre los parámetros generales de la lesividad (ver entre otras, la sentencias dictadas por esa sección números 73-2021-V, de las 15:00 horas del 17 de agosto del 2021, 102-2021-V, de las 13:23 horas del 26 de octubre del 2021 y en particular la número 2025001885, de las 11:49 horas del 28 de febrero de 2025):

“Así las cosas y, siendo el objeto de este proceso de lesividad el análisis de validez de actos administrativos de contenido favorable se hace necesario, de manera breve, establecer el cumplimiento de los diversos presupuestos que impone el ordenamiento jurídico para la formulación de un proceso de esta naturaleza, siendo que la ausencia de uno de estos elementos vedaría y haría imposible, acceder a lo propuesto en la demanda. Cabe indicar, el análisis de estos presupuestos deviene en una práctica oficiosa para el juzgador, por constituir elementos esenciales de la acción. De manera general, la lesividad se constituye en un mecanismo jurisdiccional en virtud del cual la Administración pretende la supresión de un acto suyo, propio, que, en tesis de principio, genera un efecto favorable a un tercero destinatario. Desde ese plano, en este tipo de procesos, la lesividad es de corte subjetivo, en tanto pretende la anulación de una conducta que concede un derecho o en general, una situación de beneficio a una persona.

Si bien se analiza la validez de una conducta pública concreta (y no general) de contenido favorable, ese control exige la participación del destinatario de esa conducta específica, a efectos de que pueda ejercitar su derecho de defensa y contradictorio respecto de pretensiones que buscan la alteración de su situación jurídica. Tal figura se encuentra positivizada en el canon 34 del Código Procesal Contencioso Administrativo, norma que fija los elementos previos y regulaciones procesales de esta figura. Empero, se encuentra referenciada además en el numeral 173.6 en relación con el 183 de la Ley General de la Administración Pública. Desde la óptica de los presupuestos procesales, se imponen condiciones subjetivas, objetivas, procedimentales y temporales. En cuanto a la arista subjetiva, la legitimación activa se concede a la Administración emisora del acto cuestionado, en tanto que el legitimado pasivo es el receptor de los efectos de la conducta, sea, quien obtiene sus bondades.

En lo atinente a la arista objetiva, la lesividad se constituye como un mecanismo de eliminación jurídica de actos administrativos firmes de alcance particular y de contenido favorable, que sean disconformes sustancialmente con el ordenamiento jurídico, sea, los actos que padezcan de algún nivel de invalidez, sea absoluta o relativa, en cualquiera de sus tipologías (artículos 128, 158, 165 y concordantes de la citada Ley General No. 6227). En esa línea, la Administración debe declarar lesivo a los intereses públicos esa conducta, lo que debe ser establecido dentro de un marco de acciones internas de la Administración que son impostergables para formular la acción. En efecto, en el orden procedimental, se impone que el jerarca máximo supremo de la Administración Pública respectiva declare la lesividad del acto, sea por lesión a intereses económicos, fiscales o de otra índole que se desprendan del interés público, para lo cual, ha de contar con un criterio jurídico-técnico de base que sustente esa determinación.

A diferencia de otras figuras de supresión de conductas públicas (como es el caso de la nulidad oficiosa prevista en el artículo 173 LGAP), no requiere de audiencia al tercero afectado, sino solo de acciones a lo interno de la Administración que buscan verificar la existencia expresa de voluntad administrativa emitida por el jerarca máximo, en el sentido de pretender la supresión del acto. Es dentro del proceso judicial que ese destinatario podrá establecer sus alegatos de defensa, por lo que la ausencia de su participación dentro de la fase administrativa de declaratoria de lesividad no cercena en modo alguno su derecho al debido proceso o procedimiento administrativo. Ahora bien, cuando el acto emane del Estado (ver artículo 1 de la Ley General de la Administración Pública), sea, de la Administración Central, la demanda solo podrá ser incoada por la Procuraduría General de la República (canon 16 de la Ley No. 8508), previo pedimento del jerarca máximo supremo y previa declaratoria interna de lesividad, con detalle de los motivos de ese criterio.

Cuando dimane de un ente público, las reglas de representación judicial son las establecidas en el ordinal 17 de esa misma codificación. En cuanto a la dimensión temporal, la nueva normativa procesal establece un plazo de un año contado a partir del día hábil siguiente a su emisión (que no de su comunicación) para declarar lesivo el acto a los intereses públicos en sede administrativa, a menos que su eficacia estuviera condicionada al cumplimiento de algún requisito establecido en el ordenamiento jurídico o bien, en la propia conducta formal que se pretende declarar lesiva, en los términos del numerales 141.1 y 145.1 de la Ley General de la Administración Pública. Lo anterior, salvo los supuestos en que el acto adoleciere de nulidad absoluta y tuviere efectos continuados, en cuyo caso, al tenor de lo regulado por el ordinal 34.1 del Código Procesal Contencioso Administrativo, esa declaratoria interna puede hacerse mientras perduren los efectos del acto.

En tal hipótesis, sea, el de acto con nulidad absoluta de efectos continuados, el año se computa desde el cese de sus efectos, y la sentencia que disponga la eventual nulidad, lo hará únicamente para la anulación e inaplicabilidad futura de la conducta. Luego de esa declaratoria (y no a partir del vencimiento de ese primer año), se otorga un término de un año para plantear la acción contenciosa administrativa a modo de plazo fatal de caducidad, según lo estatuye el artículo 39 del Código Procesal Contencioso Administrativo. La excepción a esta regla procesal debe estar establecida de manera expresa por la normativa procesal.[…]

VII.Sobre el incumplimiento del presupuesto temporal para la declaratoria interna de lesividad. Ahora bien, en cuanto al elemento temporal, resulta importante indicar, que el ordinal 34.1 del CPCA impone los plazos que aplican en las etapas de este trámite bajo examen. Indica la norma: "...1) Cuando la propia Administración, autora de algún acto declarativo de derechos, pretenda demandar su anulación ante la Jurisdicción Contencioso-Administrativa, previamente el superior jerárquico supremo deberá declararlo lesivo a los intereses públicos, económicos o de cualquier otra naturaleza. El plazo máximo para ello será de un año, contado a partir del día siguiente a aquel en que haya sido dictado, salvo si el acto contiene vicios de nulidad absoluta, en cuyo caso, dicha declaratoria podrá hacerse mientras perduren sus efectos…” (el resaltado no es del original).

PRESUPUESTOS SUBJETIVOS, OBJETIVOS Y DE PROCEDIMIENTO DE LA LESIVIDAD EN EL CASO CONCRETO.- Conforme a los hechos probados, mediante oficio DM-350-2014, de 03 de septiembre del 2014, el entonces Ministro de Ambiente y Energía, señor Edgar Gutiérrez Espeleta, consultó a la Procuraduría General de la República, en lo que interesa, si era procedente conceder el incentivo de riesgo del ejercicio de la función judicial a los funcionarios del Tribunal Ambiental Administrativo y quiénes tendrían legitimación para ser beneficiados. Además, cuestionó si en caso de que vía resolución administrativa se hubiera concedido el incentivo del riesgo de la función judicial a los funcionarios del Tribunal Ambiental Administrativo, qué sucede con los pagos que se habían venido realizando. Asimismo, se tiene por acreditado que la PGR, en el Dictamen C-257-2015, de 16 de septiembre del 2015 respondió la consulta formulada y dictaminó que si no existía una ley que estableciera la equiparación salarial de los miembros del Tribunal Ambiental Administrativo con los miembros de los Tribunales Superiores del Poder Judicial, no era posible reconocer a aquellos los rubros salariales que se reconocen a los integrantes de los Tribunales de la judicatura, incluido el incentivo de riesgo por el ejercicio de la función jurisdiccional.

Añadió además que no era procedente reconocer este incentivo como un derecho adquirido, pues este no ingresaba al salario de los funcionarios de forma permanente sino que el mismo estaba sujeto a requisitos o condiciones, en esencia, que los salarios y puestos de sus funciones hubieran sido legalmente equiparadas a los puestos y salarios del Poder Judicial, de manera que si el servidor no cumplía con las condiciones establecidas, el pago del incentivo debía ser rechazado. Agregó que en caso de que hubiera sido reconocido dicho pago mediante resolución administrativa, este debía ser cesado, vía artículo 173 de la Ley General de la Administración Pública o bien en los artículos 10.5, 34 y 39.2 del Código Procesal Contencioso Administrativo. Finalmente, el Tribunal ha corroborado que el Ministerio de Ambiente y Energía, con fundamento en el criterio técnico vertido por la Procuraduría General de la República declaró, en resolución R-0179-2018-MINAE, de las 13:00 del 11 de junio del 2018 que el acto de reconocimiento al pago de incentivo de riesgo del ejercicio de la función judicial a la señora María Julia Alvarado Rojas era acto lesivo a los intereses económicos del Estado.

Conforme a lo expuesto, se desprende la conformidad del elemento subjetivo, pero además del procedimental, en la medida en que constan dentro de los autos los análisis jurídicos y técnicos sobre los cuales, el jerarca administrativo basó su voluntad de acudir a esta forma de supresión oficiosa de conductas favorables. Sobre este aspecto, en cuanto al elemento subjetivo activo, la declaratoria interna de lesividad se realizó por parte del jerarca del Ministerio de Ambiente y Energía. Por otra parte, la acción se direcciona en contra de la persona destinataria de los efectos favorables de los actos impugnados, por lo que, en lo atinente al elemento subjetivo pasivo, tampoco se presenta deficiencia alguna. En lo que concierne al aspecto objetivo, la lesividad debe recaer sobre actos firmes de contenido favorable. Siendo que las actuaciones reprochadas (principales y conexas), en la medida en que se relacionan con el otorgamiento de un sobre sueldo por riesgo judicial, reconocido a la accionada en la resolución R-DRH-AJ-266-2011, de las 08:00 horas del 13 de octubre del 2011, por quien ejercía como titular de la cartera ministerial, también se cumplen los presupuestos requeridos por el ordenamiento.

Es claro que esa conducta, al margen de su validez o no, contiene un efecto beneficioso para la accionada, al concederle un derecho subjetivo consistente en un incentivo salarial. De ahí que por tutela de la doctrina de la intangibilidad de actos propios derivada del artículo 34 de la Constitución Política, su supresión por invalidez debe realizarse observando el procedimiento fijado por el ordenamiento jurídico para tales fines, como es el caso del mecanismo previsto por el artículo 173 de la LGAP, o bien, como se da en la especie, por la vía de la lesividad (art. 183 de dicha norma). Por las razones dichas, se entienden cumplidos los presupuestos subjetivo y de procedimiento, establecidos en el ordenamiento para la acción de lesividad. El objetivo será analizado con más detalle al revisar la nulidad requerida. En este punto es preciso indicar que la potestad administrativa de anular actos declaratorios de derechos subjetivos es de naturaleza excepcional, y por ese motivo el ordenamiento establece un procedimiento con la finalidad de garantizar que ésta no se ejerza de forma arbitraria.

Por este motivo, cuando la nulidad no es evidente y manifiesta, la Ley General de la Administración Pública y el Código Procesal Contencioso Administrativo, obligan a la Administración concernida a recurrir al “contencioso-administrativo de lesividad”, con la finalidad de garantizar el debido proceso, y es allí donde la parte que eventualmente resultaría afectada en sus derechos, puede participar y ejercer su defensa, de modo tal que el hecho de que en el procedimiento administrativo que antecede al judicial, la parte incidida no tenga participación ni hubiera sido comunicada de la declaratoria de lesividad, no violenta el debido proceso.

CUMPLIMIENTO DEL PRESUPUESTO TEMPORAL PARA LA DECLARATORIA INTERNA DE LESIVIDAD: En lo que concierne al elemento temporal, es preciso señalar que el inciso 1) del artículo 34 del Código Procesal Contencioso Administrativo dispone los plazos que aplican en las etapas de este trámite:

“1) Cuando la propia Administración, autora de algún acto declarativo de derechos, pretenda demandar su anulación ante la Jurisdicción Contencioso-Administrativa, previamente el superior jerárquico supremo deberá declararlo lesivo a los intereses públicos, económicos o de cualquier otra naturaleza. El plazo máximo para ello será de un año, contado a partir del día siguiente a aquel en que haya sido dictado, salvo si el acto contiene vicios de nulidad absoluta, en cuyo caso, dicha declaratoria podrá hacerse mientras perduren sus efectos…”.

La representación del Estado sostiene que los actos que aquí se cuestionan tienen efectos continuados, en la medida en que otorgan a la accionada un incentivo salarial que se le ha venido cancelando periódicamente, lo cual a su vez tiene como efecto, que no se haya producido la caducidad de la acción. Sobre casos vinculados a otros funcionarios del Tribunal Ambiental Administrativo en la misma situación de la actora, la Sala Primera de la Corte ha fijado una línea jurisprudencial en el siguiente sentido (res. número 01890–2024, de las 10:40 horas del 19 de diciembre de 2024):

“Este Órgano casacional no comparte lo resuelto por el Tribunal Contencioso Administrativo, Sección V, por las razones que de seguido se expondrán. En el fallo, emitido por esta Sala, bajo el voto número 000788-F-S1-2021, de las 10:55 hrs. con fecha 08 de abril del 2021, se abordó y resolvió una situación análoga a la presente controversia. En este contexto, se consideró lo siguiente: “IV. En otras ocasiones esta Sala ha establecido la distinción entre actos con efectos continuados y los de efecto instantáneo. Aquellos primeros, son propios de las relaciones jurídicas de duración y operan cuando el acto incide continuamente en la esfera del particular, ya sea creando, modificando o extinguiendo durante ese período las relaciones o situaciones que integran dicha esfera jurídica. Por su parte, los de efecto instantáneo, su incidencia o efecto se agota en un solo momento, precisamente el que varía de forma positiva o negativa el conjunto de derechos, potestades, obligaciones, deberes y cargas en las personas.

En este sentido puede consultarse la resolución de las 10 horas 10 minutos del 23 de octubre de 2012, que responde al voto número 1426-F-S1-2012. En el caso de estudio, la acción de personal modificó el monto económico que iba a percibir el actor, otorgándosele un aumento por rubro de prohibición, el cual se calcula como el 65% sobre la base de su salario. Dicha decisión evidentemente repercute mes a mes en la esfera jurídica del empleado, pues es con cada pago que le hace la Administración, que nuevamente ese acto surte sus efectos. Este es un clásico ejemplo de acto administrativo de efecto continuado. Entonces, el artículo 34 inciso 1) del CPCA, establece: “Cuando la propia Administración, autora de algún acto declarativo de derechos, pretenda demandar su anulación ante la Jurisdicción Contencioso-Administrativa, previamente el superior jerárquico supremo deberá declararlo lesivo a los intereses públicos, económicos o de cualquier otra naturaleza.

El plazo máximo para ello será de un año, contado a partir del día siguiente a aquel en que haya sido dictado, salvo si el acto contiene vicios de nulidad absoluta, en cuyo caso, dicha declaratoria podrá hacerse mientras perduren sus efectos. En este último supuesto, el plazo de un año correrá a partir de que cesen sus efectos y la sentencia que declare la nulidad lo hará, únicamente, para fines de su anulación e inaplicabilidad futura”. Tal y como se estableció en los hechos tenidos por demostrados, la acción de personal que nombró al señor Ramírez Guier, data del 1 de julio de 2013. La incorporación al Colegio Profesional, requisito indispensable para el reconocimiento de la prohibición, nunca fue acreditado por el demandado. Así, cada mes que recibió el pago se confirmó un pago indebido y que afectó las finanzas públicas. Mediante el oficio SRS-769-2015 del 4 de mayo de 2015, la Administración ordenó el cese de pago en cuestión.

Es decir, es mediante esta resolución, que la Administración cesa los efectos del acto administrativo en donde reconoció aquel incentivo salarial, entonces es a partir de este momento, que inicia el cómputo del lapso anual establecido en el cardinal 34 acápite 1 de cita. La declaratoria de lesividad, la hizo el Concejo Municipal, el 14 de julio de 2015, en sesión ordinaria 272, con lo cual, haciendo una simple operación aritmética, es claro, entre el cese de los efectos del acto, sea el 4 de mayo de 2015 y la declaratoria de lesividad el 14 de julio de 2015, no ha transcurrido aún el plazo que ordena el numeral 37.1 del CPCA. De tal manera, lleva razón el recurrente, y la caducidad no ha operado, por lo que no es posible declarar la inadmisibilidad de la demanda”. (En este sentido, se pueden observar los votos de esta Sala número 000788-F-S1-2021, de las 10:55 hrs. del 08 de abril del 2021. https://nexuspj.poder-judicial.go.cr/document/sen-1-0004-1034473 y No. 10-F-S1-2022, de las 10:20 hrs. del 13 de enero del 2022. https://nexuspj.poder-judicial.go.cr/document/sen-1-0004-1071319).

Con base en lo resuelto, se encuentra justificada su aplicabilidad al caso concreto, al considerar esta Cámara, que la resolución No. R-DRH-AJ-143-2009, de las 08:30 horas del 30 de marzo del 2008, emitida por el Ministro de Ambiente y Energía, donde se aprobó en favor de la demandada el incentivo de un 18% por Riesgo en el Ejercicio de la Función Judicial y ejecutado a partir de la acción de personal No. 509003257, del 1° de mayo de 2009, constituye en definitiva un acto de efectos continuados. Atendiendo a que este reconocimiento implica una erogación anual para la Administración y, por ende, representa una situación secuencial que mes a mes afecta el monto del salario, incrementando su ingreso que necesariamente se mantendrá en el tiempo y en el espacio, incidiendo reiteradamente en la esfera jurídica de la accionada. Por lo anterior, se acoge el agravio planteado”.

Habiendo ya definido la Sala Primera, que en casos como el actual sí se cumple el supuesto temporal exigido por el ordenamiento jurídico, esta Cámara considera inútil sostener una posición contraria a la ya expresada por el Superior. Esta tesis lleva aparejado el rechazo de la defensa de caducidad planteada por la parte demandada, pues el plazo para declarar lesivo para efectos de su inaplicabilidad futura empezaría a correr con el cese de los efectos, lo cual no había sucedido al momento de presentar la demanda, en tanto se tiene por acreditado que al menos hasta el 3 de junio de 2019 continuaba recibiendo el incentivo. Si se contabiliza el plazo desde que se declaró lesivo el acto cuya nulidad se solicita, que se dio en la resolución R-0179-2018-MINAE, del 11 de junio del 2018, y la fecha de presentación de la demanda (11 de marzo del 2019), tampoco transcurrió el plazo de un año entre ambos momentos, por lo que esta excepción debe rechazarse. En lo que concierne a la prescripción alegada como defensa por la accionada, el Tribunal estima que tal excepción resulta improcedente por cuanto nos encontramos ante un proceso de lesividad cuya acción se extingue por caducidad, según los términos del artículo 34 del Código Procesal Contencioso Administrativo.

LA NULIDAD DEL INCENTIVO DE RIESGO POR EJERCICIO DE LA FUNCIÓN JUDICIAL OTORGADO A LA ACCIONADA:- De acuerdo con la prueba que obra en el expediente, el Tribunal ha comprobado que, con ocasión de un reclamo administrativo formulado por la accionada Alvarado Rojas, en resolución R-DRH-AJ-266-2011, de las 08:00 horas del 13 de octubre del 2011, la entonces jerarca de Ambiente y Energía, dispuso reconocer a favor de ésta, el “… incentivo del Plus Salarial denominado Riesgo en el Ejercicio de la Función Judicial, de un 18% correspondiente de acuerdo a su cargo”. Lo anterior con fundamento en el Voto de la Sala Constitucional N°1880-96, de las 15:51 horas del 24 de abril de 1996, que otorgó dicho beneficio a los miembros del Tribunal Fiscal Administrativo. No obstante, luego de un examen de dicho pronunciamiento, el Tribunal concluye que la interpretación que la entonces Ministra a.i. de Ambiente y Energía hizo del fallo emitido por la Sala Constitucional con la finalidad de justificar el otorgamiento del incentivo, es incorrecto.

En la sentencia en cuestión -número 1880-96, de las 15:51 horas del 24 de abril de 1996-, la Sala Constitucional resolvió un recurso de amparo planteado por personas servidoras del Tribunal Fiscal Administrativo, en el cual reclamaron la infracción a su derecho de petición reconocido en el precepto 27 de la Constitución Política. En ese momento adujeron que habían gestionado ante la Dirección General del Servicio Civil su equiparación salarial en los términos dispuestos por el numeral 161 del Código Tributario. En ese asunto, el Tribunal Constitucional consideró que la referida equiparación salarial tenía su origen en un mandato legal, producido a partir de la reforma del mencionado artículo 161 del Código Tributario, y que la Administración -en este caso la Dirección General del Servicio Civil-, estaba incurriendo en el incumplimiento de la ley, lesionando además, el derecho de los petentes a la seguridad jurídica, así como su derecho a que se les aplique la equiparación salarial, a partir del precepto legal que dispuso que las tareas encomendadas a los servidores del Tribunal Fiscal Administrativo, son materialmente similares a las de los servidores judiciales y restablecer la igualdad salarial dispuesta por el legislador.

Luego, lo que dispuso el Tribunal Constitucional fue resolver la gestión de los recurrentes, para que se completara el proceso de equiparación, según lo mandaba la ley. De este modo, tenemos que el fallo de la Sala Constitucional, en el cual ésta denota esa resistencia de la Administración en orden a atender la gestión de las personas servidoras del Tribunal Fiscal Administrativo, se fundamenta en que el legislador ya había reconocido en el numeral 161 del Código Tributario, su derecho a recibir una remuneración similar a la que percibían quienes integraban tribunales colegiados en el Poder Judicial. Así, a pesar de que en la sentencia se hace referencia a que “los funcionarios del Tribunal Fiscal Administrativo han de percibir salarios o sueldos iguales a los cargos equivalentes de ciertos tribunales del Poder Judicial, esto es, que unos y otros deben recibir -en punto a la remuneración por su trabajo- el mismo trato”, al señalar esto, también indicó que ello es así porque la ley parte del supuesto de que en dichos órganos se realizan tareas similares.

En consecuencia, dicha sentencia acogió el recurso, al considerarse por parte de la Sala que, en este caso -el de los integrantes del Tribunal Fiscal Administrativo-, la Dirección General de Servicio Civil estaba incurriendo en el desacato de una norma legal que reconocía la equiparación. No obstante, de lo anterior no es posible concluir que el derecho del referido componente salarial sea extensivo de forma automática a la totalidad de funcionarios que integren tribunales administrativos, pues los puestos a quienes cobija la equiparación son únicamente aquellos a los cuales ésta se les reconozca expresamente en una norma de rango legal. Esto es así, por cuanto no puede perderse de vistas que las relaciones de empleo público están regidas por el principio de legalidad, lo cual impone limitaciones en los elementos que conforman la remuneración de las personas servidoras. En este sentido el artículo 48 del Estatuto del Servicio Civil dispone “Los sueldos de los funcionarios y empleados protegidos por esta ley, se regirán de acuerdo con las siguientes reglas:

  • a)Ningún empleado o funcionario devengará un sueldo inferior al mínimo que corresponda al desempeño del cargo que ocupe.
  • b)Los salarios de los servidores del Poder Ejecutivo serán determinados por una Ley de Salarios que fijará las sumas mínimas, intermedia y máximas correspondientes a cada categoría de empleos.
  • c)Para la fijación de sueldos se tomarán en cuenta las condiciones fiscales, las modalidades de cada clase de trabajo, el costo de la vida en las distintas regiones, los salarios que prevalezcan en las empresas privadas para puestos análogos y los demás factores que estipula el Código de Trabajo.
  • d)Dentro de las cifras mínimas y máximas de que habla el inciso b), los Jefes respectivos podrán acordar aumentos de sueldos, atendiendo a factores como la eficiencia, la antigüedad, la conducta, las aptitudes y demás cualidades que resulten de la calificación periódica de sus servidores, todo esto con sujeción a lo que al efecto disponga la Ley de Salarios. Los Jefes de las diversas secciones del personal administrativo, deberán obtener de previo a tales aumentos, la venia del supervisor jerárquico; aumentos que estarán sujetos a lo dispuesto en el inciso e) de este mismo artículo; y e) Queda prohibido a la Tesorería Nacional extender giros a favor de empleados o funcionarios, por sumas distintas a las mínimas fijadas en el Presupuesto o Ley de Salarios; y en el caso del inciso anterior, el aumento no se hará efectivo sino cuando esté incluido en la Ley de Presupuesto Ordinario, o en un presupuesto extraordinario. La Dirección General de Servicio Civil, informará a la Tesorería Nacional de los aumentos de los sueldos de los servidores públicos”.

En esta misma línea, la Ley de Salarios de la Administración Pública N°2166 de 09 de octubre de 1957, vigente para el caso bajo estudio, señala en su artículo 1:

"La presente ley se dicta para garantizar la eficiencia de la Administración y constituirá el sistema de retribución para todas las clases de puestos clasificados en el manual descriptivo de puestos, conforme lo dispone el capítulo X del Estatuto del Servicio Civil".

De la normativa transcrita, se sigue que en las relaciones de empleo público, los distintos rubros que componen el salario, o bien, que han de considerarse para establecerlo de forma global, deben estar definidos en la ley, de manera tal que los componentes salariales que pueden reconocerse válidamente, serán solamente aquellos que resulten de una norma de rango legal, o bien aquellos contenidos en una disposición de rango superior. En este sentido, la Sala Constitucional, en el voto N°2012-003267 de las 16:01 horas del 07 de marzo del 2012, al revisar la constitucionalidad del artículo 63 del reglamento Autónomo de Servicio del Ministerio de Hacienda señaló:

“III.- Sobre el fondo. A.- Sobre la relación de empleo público.- Desde el dictado de la sentencia No. 1992-01696, esta Sala Constitucional ha sostenido, en múltiples ocasiones, que la relación de empleo público es una relación de derecho público o estatutaria, que tiene limitaciones inherentes en cuanto a la aplicación del derecho laboral común, de manera que no todas las liberalidades del patrono son posibles. De igual manera, la Constitución Política de 1949 marca el momento a partir del cual el régimen laboral público toma vigor en el ordenamiento jurídico, lo que conlleva un fuerte sometimiento a los artículos 11, 191 y 192 de la Constitución Política. Con anterioridad a 1949 la Constitución Política nada establecía respecto de la relación laboral entre el Estado y los servidores públicos. Por su parte, por resolución No. 2000-4453 la Sala establece con mayor claridad las limitaciones a la negociación colectiva entre los funcionarios que ejercen la gestión pública de aquellos que no, y la posibilidad de éstos de tener acceso a estos medios de negociación colectiva.

En este sentido, el Estado y el funcionario público se encuentra bajo una relación de sujeción especial, que sitúa al funcionario público en su relación laboral en una situación muy distinta al trabajador en una relación laboral común y, a su vez, la relación estatutaria tiene especiales alcances para la Administración Pública. En una relación estatutaria, el Estado tiene una relación preeminente sobre el funcionario público, que les vinculan durante toda la relación laboral pública y, a su vez, ésta queda regida por un ordenamiento jurídico público (...). No obstante lo sostenido anteriormente, en cuanto se reconoce que cada Administración Pública puede acordar beneficios y condiciones particulares de los trabajadores en forma unilateral, la Sala debe profundizar en las razones en que dichos beneficios deben estar al menos autorizados en el bloque de legalidad y de constitucionalidad, es decir, deben tener un fundamento legítimo (ajustado a la ley) o acordado en forma proporcionada a los fines que se persigue con el servicio público que se presta.

(...). Ahora bien, una vez determinado que las relación [sic] de servicio entre la Administración Pública y sus servidores públicos es estatutaria, no puede prescindirse del impacto que conlleva los beneficios acordados unilateralmente sobre los recursos públicos, muchas veces acordados por sectores y aisladamente, si no es aprobado por medio de una norma legal. Es claro para la Sala que muchas medidas administrativas tienen efectos sobre las finanzas públicas, especialmente cuando éstas conceden beneficios, lo que se constituyen en un medio para eludir un principio fundamental del derecho público: el principio de reserva de ley. En este sentido, ciertas obligaciones sobre el Erario Público no solo deben ser valoradas desde un ángulo administrativo, sino de política económica de Estado, en el tanto que existe una carga sobre los recursos públicos, y en donde el legislador tiene una función toral.

En este sentido, es importante señalar que sobre este tema, la Sala modifica su criterio lo que tiene una consecuencia sobre los precedentes citados supra, es decir, las Administraciones Públicas tienen limitaciones para otorgar ciertos beneficios salariales que no encuentran apoyo en la normativa legal. B- Sobre el principio de reserva de ley.- No hay duda que por el principio de legalidad de la Administración Pública solo puede hacer aquello que esté previamente autorizado en una norma de esa naturaleza, en consecuencia puede acordar y regular lo que le permita una disposición legal. De igual manera, existen determinadas materias en las que solo el legislador puede regular apropiadamente, dado que se trata de una norma formal y material que cumple con los requisitos de su formación, de conformidad con el principio democrático y, en consecuencia, no puede el Poder Ejecutivo regularlos autónomamente.

En términos de lo sostenido con anterioridad por esta Sala, en su sentencia No. 1992-03550, indicó que: "En tercero, que ni aún en los reglamentos ejecutivos, mucho menos en los autónomos u otras normas o actos de rango inferior, podría válidamente la ley delegar la determinación de regulaciones o restricciones que sólo ella estaba habilitada a imponer(...)"Por esta razón, el régimen de los derechos fundamentales queda reservado a la ley. Si bien, la Ley General de la Administración Pública autoriza y desarrolla la potestad reglamentaria, es lo cierto que, cuando se conceden beneficios laborales, que se reducen a una licencia a favor de los funcionarios para recibir un salario sin trabajar, efectivamente contrae los principios y derechos constitucionales, así como legales, pues invierte la jerarquía normativa. El otro tema es que el Estatuto de Servicio Civil regula las vacaciones de los funcionarios públicos sometidos al régimen de servicio civil, sin embargo a juicio de este Tribunal no puede venir una norma reglamentaria a ampliar un derecho regulado en la Ley, utilizando otra institución jurídica que finalmente concede beneficios similares.

En este sentido, no podría una norma de menor rango modificar los preceptos legales que establecen una forma ordenada de administrar y ejecutar los recursos públicos, mucho menos si incide en el principio que emana del artículo 140 inciso 7) de la Constitución Política que impone al Presidente y Ministro de Gobierno, disponer la inversión de las rentas nacionales de acuerdo con las leyes. De ahí que es aceptado que las Administraciones Públicas se encuentran controladas por el principio de legalidad, lo que también sucede con mayor rigor con el principio de la legalidad financiera, dado que están de por medio fondos públicos. Este principio de legalidad se manifiesta en el manejo, la administración, el destino y custodia de los recursos públicos, por lo que el legislador, mediante la Ley No. 8131 de 18 de septiembre de 2001, Ley de Administración Financiera y Presupuestos Públicos, señala, en el artículo 5, los diferentes principios, entre ellos el principio de gestión financiera.

La norma la define de la siguiente manera: “Para los efectos del artículo anterior, deberán atenderse los siguientes principios presupuestarios: a)…b) Principio de gestión financiera. La administración de los recursos financieros del sector público se orientará a los intereses generales de la sociedad, atendiendo los principios de economía, eficacia y eficiencia, con sometimiento pleno a la ley (...). En este sentido, el legislador insertó en el ordenamiento jurídico y desarrolló, dentro de la Administración Pública, el principio de legalidad financiera totalmente consecuente con el artículo 140 inciso 7) de la Constitución Política, eliminando un uso no autorizado de los recursos públicos con la mera discrecionalidad de la Administración Pública mediante un Reglamento Autónomo o acto de Derecho público no autorizado expresamente por ley. Precisamente el legislador despejó toda duda de los alcances del principio al señalar radicalmente el sometimiento pleno en la ley.

De igual forma, mediante el artículo 107, al referirse al principio de legalidad, señala que: “Los actos y contratos administrativos dictados en materia de administración financiera, deberán conformarse sustancialmente con el ordenamiento jurídico, según la escala jerárquica de sus fuentes. Se presume la legalidad de los actos y las operaciones de órganos y entes públicos sujetos a la presente ley, pero se admitirá prueba en contrario.” En consecuencia, se deberá conformar sustancialmente con el ordenamiento jurídico, de manera que no existe una discrecionalidad total de la Administración Pública para crear fuentes de gastos, sino, por el contrario, debe mediar una autorización legal. Es igualmente importante señalar que las obligaciones económicas de la Hacienda Pública se pueden originar en la Ley, de igual manera, pueden originarse en las resoluciones jurisdiccionales (artículos 122 y 153 de la Constitución Política), y en los contratos y actos administrativos cuando media alguna forma de obligaciones basadas en determinadas manifestaciones de la voluntad del Estado.

Sin embargo, es importante aclarar que esas manifestaciones no pueden ser entendidas desde un punto de vista civil o laboral privado, no solo por lo que se indicó supra, sino, por el contrario, dado que se refiere a formas contractuales cuyo origen precisamente se encuentra en la ley o que la ley señala los mecanismos para generar estas obligaciones económicas".

En el asunto bajo examen, el Tribunal ha tenido como un hecho probado que en la resolución R-DRH-AJ-266-2011, el Ministerio de Ambiente y Energía reconoció a la señora María Julia Alvarado Rojas el incentivo del riesgo de la función judicial, actuación que fundamentó en el fallo de la Sala Constitucional 1880-96, el cual, como se indicó anteriormente, no tenía el efecto de extender la aplicación del beneficio dispuesto en el numeral 161 del Código Tributario para los integrantes del Tribunal Fiscal Administrativo, a otros órganos similares existentes en la Administración Pública, pues lo que allí se determinó fue la conducta omisiva de la recurrida en orden a dar cumplimiento a la ley que establecía el incentivo. Así, un beneficio de esta naturaleza únicamente podría ser establecido por la Ley, sin perjuicio, claro está, de que en sede jurisdiccional o administrativa resulte posible su reconocimiento, e incluso establecer la obligatoriedad de su pago, cuando ello resulte de la aplicación de la norma de rango legal creadora del beneficio.

En la especie, eso no ocurre, a pesar de que evidentemente, el pago del incentivo denominado Riesgo de la Función Judicial, de un 18% tiene una incidencia en los fondos públicos. El Tribunal estima que una concesión de esta naturaleza, que tiene efectos en el erario, debe estar autorizada expresamente por ley, de modo que para que las personas que prestan sus servicios en el Tribunal Administrativo Ambiental gocen del referido incentivo salarial, es el legislador el que debe aprobar la erogación, luego de valorar si la equiparación es razonable y si tiene o no fundamento. Luego, los alegatos de la accionada en el sentido de que su labor como miembro de un tribunal administrativo se equipara las funciones ejercidas por un órgano jurisdiccional, y es similar a la llevada a cabo por el Tribunal Fiscal Administrativo, carecen de relevancia en este caso, por cuanto la imposibilidad de acoger sus alegatos radica en el hecho de que el fundamento de base de la resolución R-DRH-AJ-266-2011, no tiene amparo en una ley que realice la equiparación y autorice el pago.

Por otra parte, la accionada aduce que por la vía de lesividad se violenta el principio de no regresión en materia ambiental. Sin embargo, el Tribunal no comparte dicho alegato, toda vez no ha sido demostrado en autos cómo la anulación del incentivo por riesgo judicial tiene una incidencia directa en la defensa y preservación de un ambiente sano y ecológicamente equilibrado, al punto de que su supresión vulnere el principio de no regresión en materia ambiental. Si bien este Órgano entiende que la remuneración que se reconoce a los servidores públicos, puede tener incidencia en la calidad de su gestión, esos aspectos deben ser acreditados en la instancia correspondiente, para que a través de la ley se reconozcan los componentes salariales que aseguren funcionarios que presten servicios de excelencia. Por otra parte, tampoco son de recibo los argumentos en el sentido de que la declaratoria de lesividad vulnera el principio de no regresión en materia laboral, pues está claro que dicho postulado cobija derechos válidamente adquiridos, lo cual no ocurre en la especie, pues como se ha indicado, las circunstancias que originaron el reconocimiento del incentivo por riesgo judicial a favor de la accionada no tienen respaldo en la ley, requisito indispensable para su validez.

EXCEPCIONES.- A tenor de lo dicho en los considerandos que anteceden, lo procedente será rechazar las defensas de caducidad, prescripción y falta de derecho, con lo que procedería declarar la nulidad de la resolución R-DRH-AJ-266-2011 de las 8:00 horas del 13 de octubre de 2011 y sus actos conexos, y disponer la inaplicabilidad inmediata del incentivo de Riesgo en el Ejercicio de la Función Judicial en favor de la parte accionada, únicamente para efectos futuros.

COSTAS.- Según regulación del artículo 193 del Código Procesal Contencioso Administrativo, las costas personales y procesales constituyen una carga que se impone a la parte vencida por el hecho de serlo y sólo procede su dispensa cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar, o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En el caso de estudio, este Órgano Colegiado considera que la accionada ha tenido motivo suficiente para oponerse a la demanda, toda vez que es precisamente esta vía, la única que le brinda el ordenamiento para ejercer su derecho de defensa, pues la ley no prevé su intervención en la etapa de declaratoria de lesividad en sede administrativa; sin perjuicio además, de que con fundamento en el principio de confianza legítima, la demandada tenía motivos para razonablemente concluir que tenía derecho a recibir el incentivo por riesgo judicial, no solo porque este se reconoce por el ordenamiento jurídico a las personas servidoras de órganos administrativos similares al que ella integra, sino además, porque le fue expresamente reconocido su derecho por el jerarca del Ministerio de Ambiente y Energía.

POR TANTO

Se rechazan las defensas de caducidad, prescripción y falta de derecho. Se acoge la demanda de lesividad planteada por el ESTADO contra MARÍA JULIA ALVARADO ROJAS. Se anula la resolución R-DRH-AJ-266-2011 de las 8:00 horas del 13 de octubre de 2011 así como sus actos conexos y se ordena la inaplicabilidad, firme esta sentencia, del incentivo de riesgo en el ejercicio de la función judicial en favor de la parte accionada únicamente para efectos futuros.
