WHEREAS:

I.Claims: The plaintiff files an action for the removal of a tree, which she values at two hundred colones, requesting that the Court declare: “1.- Based on the facts stated, legal grounds, and evidence submitted, I request that Your Honor GRANT this possessory action (acción interdictal), conduct an on-site judicial inspection (reconocimiento judicial in sitio), and, as soon as possible, given that the MINAE report is available, order the defendant, at her own expense, to remove the tree at issue within a reasonable period, with the warning that if she fails to do so, her representative will be prosecuted for the offense of disobedience of authority. 2.- In the alternative, I request that she be ordered, at her own expense, to prune the tree within a reasonable period and every 6 months to prevent the tree from growing so tall, with the warning that if she fails to do so, her representative will be prosecuted for the offense of disobedience of authority.” (See the electronic case file, submissions folder, dated 24/03/2023).

II.Defenses raised. The defendant opposed the complaint and raised the defenses of lack of interest (Falta de interés), lack of standing to sue (Falta de Legitimación activa), and lack of standing to be sued (Falta de Legitimación pasiva). By order issued at fourteen hours and twenty-two minutes on the twenty-second of April, two thousand twenty-four, the response to the complaint was deemed untimely. III.Judge María Carolina Hurtado García of the Agrarian Court of the First Judicial Circuit of Alajuela, in judgment N° 2024000216 issued at sixteen hours and two minutes on the twenty-ninth of November, two thousand twenty-four, ruled: “THEREFORE: In accordance with the foregoing, the complaint is granted. Consequently: “1) The defendant is ordered to cut down the tree at issue in this matter within TWO MONTHS. That tree is of the Guapinol species, as described in the record of the judicial inspection conducted in these proceedings.

  • 2)The defendant shall bear the costs of cutting down the Guapinol tree. The defendant is likewise instructed to perform that work responsibly, ensuring that it does not cause injury to third parties or damage to property and that no debris or waste produced by the work remains. She shall also notify any persons who may be adversely affected by the work so that they may take the appropriate safety measures. The defendant shall take the appropriate steps to obtain insurance coverage for the persons she hires to perform the pruning.
  • 3)If usable timber results, the defendant is authorized to use it. If the usable timber must be transported outside the property, the defendant shall obtain the appropriate transport documents and permits from MINAE.

IV.The proven facts set forth in the challenged decision are upheld because they are supported by the evidence contained in the record.

V.Through her public defender, attorney Jesús Andrés Chaves Mora, the defendant filed an appeal, stating that the purpose of this proceeding is to determine whether a tree, because of its poor condition, poses an imminent danger of falling that threatens the lives and safety of persons, their property, or public property (sections 310 of the Civil Code and 108 of the Code of Civil Procedure, applied supplementarily in this matter). In this summary proceeding, it must be determined whether that forest species must be removed to prevent a harmful event that, unless such measures are taken, has a high probability (imminence) of occurring now or in the very near future. She argues that the requirements for this action relate to the element of dangerousness, for which the following must be established: a) The tree whose removal is sought must pose an imminent threat, due to the danger of falling, to the rights of the possessor or passersby (their physical integrity, lives, or property), or it must be capable of damaging something. b) Right.

Although the legal system confers the right to remove dangerous trees, there must be just cause for doing so. When a tree is involved, given the environmental-protection regulations currently in force in the country, it is necessary to verify that cutting it down or removing its branches is truly necessary; the applicable requirements must therefore be met to prevent an unlawful or unnecessary removal. Accordingly, even if a tree is diseased or in danger of falling, if it does not actually threaten the physical integrity or property of any person, its removal should not be authorized because there is no other legally protected interest at stake; on the contrary, allowing it to fall naturally may be necessary for the environmental balance of the ecosystems. c) Present interest: the property whose removal is requested must exist, and the situation involving an imminent danger of falling must persist both when the complaint is filed and when judgment is rendered.

She points out that this procedural avenue should not be used to resolve problems arising from neighbor relations due to noncompliance with specific regulations governing the minimum distance from property boundaries at which trees may be planted, except as concerns an actual danger or risk of the entire tree or its branches falling (sections 403 and 404 of the Civil Code). Disputes that may arise from roots and other matters that do not constitute factors capable of causing the tree to fall imminently must be litigated through the appropriate procedural avenue, which is ordinarily an ordinary proceeding, to guarantee due process to the parties involved and because of the type of evidence usually required. She states that the technical opinion issued in this proceeding (report by a SINAC official in Grecia N° SINAC-ACC-OG-inf-0475-2024) is insufficient to establish that the tree at issue poses an imminent danger or genuine threat.

She recounts the following statements made therein: “At the time of the inspection, no dynamic or static loads were found that jeopardized the tree’s structural stability. At the time of the field inspection, the tree showed no symptoms of pathogen damage. The tree is leaning slightly toward the southwest, in the direction of the main road. Some pruning of upper branches was identified and had been performed incorrectly; however, the affected areas underwent an adequate recovery or compartmentalization process. Those affected areas adequately developed a barrier zone to encapsulate the damage and prevent the tree from losing vitality or pathogens from entering. The trunk has three healthy main axes. Resin flow was observed at the cut where a thick branch had been removed from the stem; this is normal during a tree’s recovery from a wound, and compartmentalization is progressing adequately.

The tree collar was buried; in the future, this could cause the tree to lose vitality because stems are not adapted to being buried, and this leads to pathogen attacks, causing disease and the inevitable loss of vitality. The branches and tree would subsequently fall. Part of this tree’s stem is buried, which could allow pathogens to enter it in the future because the tree’s stem is not a structure adapted to being buried.” In this regard, the appellant contends that this specialist’s report does not establish that the tree poses an imminent danger of falling or is otherwise hazardous. Nor were any other items of evidence submitted that would support the conclusion reached in the appealed judgment. She argues that the judgment acknowledges there is no certainty as to when the tree might fall but nevertheless chooses to anticipate that event, without considering that this type of proceeding requires the threat to be real and present.

In other words, the risk of falling must be imminent. As a living organism, a tree may logically ultimately die by falling. But unless it is proven that this event could occur at any time in the present, the situation should not be unjustifiably accelerated. She argues that there is no reliable evidence establishing a present risk that would justify cutting down the entire tree. The requirements for removal have therefore not been met, and such removal would adversely affect the environment, the biological landscape, and ecosystem preservation. She requests that the appealed judgment be reversed and the present complaint dismissed (electronic case file, submissions folder, dated 06/12/2024, images 113 to 117, PDF format).

VI- In the appealed decision, the court ruled on the claimant [Name 001]’s request to fell the tree, alleging that it poses a danger and causes damage to her property. Of relevance, among the established facts, it was deemed proven that the Guapinol tree is located on the defendant’s property, near the claimant’s dwelling, with branches extending over her roof and toward the power lines. It measures 80 centimeters in diameter and 11 meters in height, with a crown spread of 16 meters. No immediate structural damage or signs of disease or pathogen-related damage were found during the field inspection. The tree was found to lean slightly toward the public roadway, and part of its trunk is buried, which could, in the future, allow pathogens to enter and cause a loss of vitality, with the risk of branches or the entire tree falling. Furthermore, it was not proven that the roots are damaging walls on the claimant’s property, although the proximity of branches to the roof and entrance of the house was confirmed.

The decision is based on Article 108 of the Code of Civil Procedure, which permits summary proceedings for felling when a tree constitutes a threat to the rights of possessors or passersby, or to public property. The decision analyzed the content of Technical Report No. SINAC-ACC-OG-inf-0475-2024, issued by the SINAC office in Grecia, and the judicial inspection, from which it was concluded that, although no imminent risk was found, a potential future risk was identified due to the condition of the tree (buried trunk, possible loss of vitality, and falling). The judgment stated: “The root collar of the tree was buried; in the future, it is possible that the tree may lose vitality because trunks are not adapted to being buried, and this causes them to be attacked by pathogens, resulting in disease and the inevitable loss of vitality. This would subsequently cause branches and the tree itself to fall.

Part of this tree’s trunk is buried, and in the future this could allow pathogens to enter it, since the tree trunk is not a structure adapted to being buried. Having reviewed the relief sought in the complaint and assessed both the documentary evidence submitted to the record, the judicial inspection conducted, and the report from the SINAC office in Grecia, this judge considers it necessary to order safety measures. In this case, it is appropriate to order the tree in question to be cut down. This is because, although the officials from the SINAC office in Grecia stated that no phytosanitary damage was observed in the tree, it is also true that they mentioned that the tree could lose vitality in the future (listen to the audio recording of the judicial inspection), and their report states: ‘because trunks are not adapted to being buried, and this causes them to be attacked by pathogens, resulting in disease and the inevitable loss of vitality.

This would subsequently cause branches and the tree itself to fall. Part of this tree’s trunk is buried, and in the future this could allow pathogens to enter it, since the tree trunk is not a structure adapted to being buried’ (see the report incorporated into the record). This tree is more than ten meters tall, and its surroundings include occupied houses, a frequently used roadway and pedestrian sidewalk, as well as power lines. This judge considers it necessary to order this tree to be cut down to prevent it from causing future harm to persons passing through the area or living in nearby houses. This is due to its considerable height, the possibility of falling branches, and the particular condition observed, insofar as SINAC officials indicated that pathogens could enter in the future because the trunk is not a structure adapted to being buried, coupled with the observation during the judicial inspection that the pruning performed was inadequate (listen to the audio recording).

Likewise, natural events such as strong winds and others could cause branches or the tree itself to fall. During the judicial inspection, it was observed that most of the weight of the branches is directed toward the public roadway and that there are branches over the entrance to and near the roof of the claimant’s house. It is therefore apparent that keeping this tree standing poses a danger, given the situation described in the SINAC report concerning the future impairment of the tree’s stability because its root collar is buried (listen to the audio recording of the judicial inspection and see the written report contained in the record).” VII– The appellant defendant argues that the substantive law was improperly assessed with regard to the need to establish the poor condition of the tree species as a necessary prerequisite for ordering its felling. After reviewing the record, that claim must be rejected because the appealed decision concluded, on the basis of the technical evidence submitted, that although the tree currently poses no immediate danger, there is a real future threat and risk of harm to persons and property due to its height, location (adjacent to dwellings and over the public roadway), and potentially compromised phytosanitary condition.

The appealed decision weighed the safety interests of residents and passersby, the threat and risk of what will occur in the future, notwithstanding the uncertainty as to how long it will take, given the tree’s current condition, as well as the prevention of damage to the claimant’s infrastructure and property. In this particular case, a scientific technical report has anticipated what will occur because the tree’s root collar is buried, although trunks are not adapted to withstand that condition, and the consequences of that condition for the future stability of the species were identified, resulting in a moderate risk rating. This Chamber considers that the foregoing assessment was made for the purpose of protecting the physical integrity of neighboring residents and passersby on the street toward which the tree leans. The decision is deemed justified, as the threat described in Article 108 of the Code of Civil Procedure, which applies supplementarily, has been established.

In this regard, the aforementioned SINAC technical report and the photographs show the risk of the tree falling onto the public roadway and causing personal injury and property damage, including damage to neighboring dwellings. The requirements for tree-felling proceedings are therefore satisfied, given the threat posed by keeping the tree standing under the conditions in which its root collar is buried, as identified in the technical report issued by the authority with jurisdiction over forestry matters. Under the heading “Nearby Infrastructure,” the report states: “The following elements lie within the tree’s potential fall zone: Dwelling 1. This dwelling is located northeast [sic] of the tree and has a high occupancy rate, since at least one person resides there 24 hours a day. Dwelling 2. This dwelling is located on the same property as the tree in question, at a distance of 3 meters from it.

It also has a high occupancy rate, since at least one person resides there 24 hours a day. Dwelling 3. This dwelling is located southwest of the tree and has a high occupancy rate, since at least one person resides there 24 hours a day. Paved roadway: This roadway is located in front of the tree and has a high occupancy rate, since vehicles and people are constantly traveling through the area. Power lines: The power lines are located in front of the tree, on the other side of the roadway described above. Pedestrian sidewalk: This sidewalk is located in front of the tree, on the other side of the roadway described above, and has a high occupancy rate, since people are constantly passing through the area.” Regarding the risk classification, the following was noted: “Risk classification. According to the risk assessment applied to the tree, its risk level is moderate. The only negative condition is that part of the tree trunk is buried, which could allow pathogens to enter it in the future because the tree trunk is not a structure adapted to being buried.” The document states that the assessment of the risk posed by the tree was conducted using the ISA (International Society of Arboriculture) Basic Tree Risk Assessment Form for Urban Trees, and the photographs are included in the record. (images 78 to 82 in PDF view).

VIII- In the view of this Chamber, under the conditions cited, several factors must be weighed, such as observance of the fundamental rights of persons in judicial proceedings, in protection of the right to human life, integrity, and health. Such precedence must be applied within the framework of the right to sustainable development, to ensure the exercise of those rights in balance with the right to a healthy and ecologically balanced environment. The foregoing is consistent with the development of a Social State under the Rule of Law (Estado Social de Derecho) (artículos 21, 45 y 50 de la Constitución Política). In the event of a conflict between rights of different categories, it must be resolved by applying the right of higher rank (voto 972-90 de las 14:10 horas del 22 de agosto del 1990 de la Sala Constitucional de la Corte Suprema de Justicia). That same High Court has held: “ … The exercise of fundamental rights, such as private property and freedom of commerce, is not unrestricted and must be limited for reasons of social welfare.

The right to a healthy environment, health, and physical integrity are fundamental rights that the State must protect” (voto 240.92 de las 9:00 horas del 31 de enero de 1992 y en este sentido voto 1488-92 de las 16:03 horas del 3 de junio del 1992). Accordingly, in light of the ruling in the appealed judgment, insofar as it orders the felling (corta) of the tree because of the threat it poses and its location, the medium risk must be assessed together with the future threat identified as arising from the burial of the tree’s root collar. The judgment weighed the rights to life and safety of the persons in the area surrounding the tree that is the subject of these felling proceedings (proceso de derribo). Regarding the consideration of risk factors or the likelihood that a forest species or its branches may fall due to elements external to the tree, this Court held in voto N° 2025000273 de las 12:05 horas del 26 de marzo del 2025: “According to the Real academia española, the word ‘ruinous’ means: ‘Beginning to fall into ruin or threatening ruin.’ According to Cabanellas, ruinous means: ‘That which causes financial ruin.’ As to ruin, the cited text defines it legally as follows: ‘destruction or falling of a thing// Loss, perdition, devastation.// Decline.// Poverty following wealth or modest circumstances.// The condition of one who is left without property because of misfortune, vice, or dispossession by another; and this, more through perfidy than through violence’ (Cabanellas, G. Diccionario enciclopédico de Derecho usual.

Thus, when meaning must be given to the concept of unsafe property (bien ruinoso) for the issuance of a safety measure (medida de seguridad), the evidence must be used to determine whether the forest species is in an unsafe condition. From a technical perspective, various factors must be weighed to reach the conclusion that it constitutes unsafe property or is in poor condition. According to forestry engineer Erick Hernández Garzón, in the scientific article ‘Risk Assessment of Urban Trees’ (‘Evaluación del riesgo en árboles urbanos’) (2020), the assessment criteria must consider: ‘Tree: It is recommended that a record be made of the tree’s defects, taking into account its roots, trunk, and crown, and that an effort be made to reconstruct its life history from the nursery onward, including the pruning it has undergone. • Site conditions: Factors such as topography, tree exposure, rainfall, wind speed, and soil modifications such as movement, compaction, or uplift must be assessed. • TARGET: identify the person or infrastructure that could be harmed.

Bear in mind that there are movable and immovable objects’ (p.72 https://www.ambientico.una.ac.cr/wp-content/uploads/tainacan items/5/31241/275_70- 76.pdf). Thus, when the aforementioned factors are weighed, the technical assessment must consider the condition of the tree; the site conditions, which involve factors relating to topography and wind; and the target, which entails weighing the persons or infrastructure that could be harmed, whether movable or immovable. It is essential to understand the scope of the probabilities of failure and the categorization of the impact on the target, which assist in interpreting the technical report regarding site conditions and the target. Regarding the categorization of the probability of failure, the cited document details four categories: ‘Imminent: Failure has begun or is more likely to occur in the near future, even if there is no wind or increased load. • Possible: Failure could occur, but is unlikely under typical atmospheric conditions.

High likelihood of failure in strong winds. • Probable: Failure is expected under normal weather conditions. • Improbable: The tree is unlikely to fail even under severe weather conditions.’ With regard to the probability of impact, there are four levels: ‘High: The target is likely to be affected • Medium: The target may or may not be affected. • Low: The target is unlikely to be affected • Very low: The possibility of impacting a target is remote’ (Hernández Garzón (2020) p.74). The cited source reasons that a forest species may be in good phytosanitary condition (estado fitosanitario), but cracks in the trunk could establish the probability of imminent failure, meaning that it could occur in the near future…… ). Other information that must be weighed, in addition to the condition of the tree, includes the site conditions… When a safety measure is considered, the phytosanitary condition, the site conditions, and the target must be analyzed, as each of these factors was explained supra.

In this case, the appealed decision assesses the site conditions and the target.” Accordingly, in this case, consideration must likewise be given to the tree’s location in relation to the presence of persons, pedestrians, vehicles, and dwellings, as well as the fact that the tree’s root collar is buried, which will cause problems and risks of falling that cannot be disregarded, since there is no certainty as to when that event will occur.

IX- For the reasons stated, pursuant to artículos 1, 2 y 54 de la Ley de Jurisdicción Agraria y 101 del Código Civil, resolución N° 2024000216 de las dieciséis horas con dos minutos del veintinueve de noviembre del año dos mil veinticuatro must be affirmed as to the matters appealed.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas veintiocho minutos del veintiuno de mayo de dos mil veinticinco.- SUMARIO DE DERRIBO establecido por [Nombre 001], [...]; contra ARACELLY ALVARADO CALDERÓN, mayor, ama de casa, divorciada, vecina de Alajuela, cédula de identidad tres - doscientos sesenta y tres - trescientos siete. Actúan como defensores públicos en materia agraria de la parte actora, el licenciado, Luis Guillermo Vargas Mena, carné veintisiete mil cuarenta y dos; y de la parte demandada el letrado Jesús Chaves Mora, colegiado veinticinco mil ochocientos treinta y cinco. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de Alajuela.

Redacta la jueza Castro García; y,

CONSIDERANDO:

I.De las pretensiones: Interpone la parte actora demanda de derribo de árbol, que estima en doscientos colones, solicitando se declare: “1.- " Por los hechos narrados, fundamentos de derecho y pruebas aportadas solicito a su Autoridad DECLARAR CON LUGAR esta acción interdictal, se proceda a realizar un reconocimiento judicial in sitio y que a la brevedad posible por contar con el informe del MINAE se ordene a la demandada proceder a su costa con el derribo del árbol en cuestión en un plazo prudencial, bajo apercibimiento que de no hacerlo será juzgada su representante por el delito de desobediencia a la autoridad. 2.- Subsidiariamente, solicito se le ordene la poda a su costa del árbol en un plazo razonable y cada 6 meses para evitar que el árbol pueda tomar tanta altura, bajo apercibimiento que de no hacerlo será juzgada su representante por el delito de desobediencia a la autoridad." (Ver el expediente electrónico bandeja de escritos de fecha 24/03/2023).

II.Excepciones deducidas. La parte demandada contesto negativamente la presente y presento las excepciones de Falta de interés, Falta de Legitimación activa y pasiva. Mediante resolución de las catorce horas con veintidós minutos del veintidós de abril del año dos mil veinticuatro se tiene por contestada la demanda en forma extemporánea. (Ver en el expediente electrónico bandeja de escritos de fecha 17/04/2024 y en documentos asociados de fecha 22/04/2024, imagen 70).

III.La jueza María Carolina Hurtado García del Juzgado Agrario del Primer Circuito Judicial de Alajuela, mediante sentencia N° 2024000216 de las dieciséis horas con dos minutos del veintinueve de noviembre del año dos mil veinticuatro, resolvió: “POR TANTO: De conformidad con lo expuesto, se acoge la demanda. En consecuencia: "

  • 1)Se ordena a la parte demandada que en el plazo de DOS MESES debe proceder a la corta del árbol objeto de este asunto. Dicho árbol es de la especie Guapinol, descrito en el registro del reconocimiento judicial llevado a cabo en autos.
  • 2)Para dicha labor de corta del árbol de Guapinol, la demandada asumirá los costos. De igual modo, se previene a la parte demandada que debe ejecutar esa labor con responsabilidad de velar que al momento de ésta no se afecte a terceras personas en su integridad, ni bienes materiales, y no queden residuos o basura originada por esa labor. Deberá además, dar aviso a las personas que puedan verse perjudicadas con esta labor, para que tomen las medidas de seguridad pertinentes. La parte demandada realizará las gestiones pertinentes de aseguramiento de las personas que contrate para realizar la poda.
  • 3)Si resulta madera aprovechable, se autoriza sea aprovechada por la demandada. De requerir el transporte de madera aprovechable fuera de la propiedad, debe la demandada proceder a gestionar ante MINAE las guías y permisos de transporte pertinentes.
  • 4)Se resuelve sin especial condenatoria en costas.” (expediente electrónico, bandeja de documentos asociados sentencia primera instancia, fecha 29/11/2024 16:02:04).

IV- Se avalan los hechos probados contenidos en la resolución recurrida por encontrar sustento en los elementos probatorios que constan en autos.

V.La parte demandada por medio de su defensor público licenciado Jesús Andrés Chaves Mora, interpuso recurso de apelación exponiendo la finalidad de este proceso es determinar si un árbol, por su mal estado, constituye un peligro inminente de caída que afecte la vida y seguridad de las personas, su patrimonio o bienes de naturaleza pública (numerales 310 del Código Civil y 108 Código Procesal Civil, aplicado supletoriamente a esta materia). Dentro del presente sumario ha de establecerse si esa especie forestal debe ser eliminado a fin de prevenir una situación dañina que, de no tomarse esas medidas, tiene un alto grado de probabilidad (inminencia) de acontecer en tiempo presente o muy cercano. Refuta, los presupuestos de esta acción se relacionan con el elemento de peligrosidad, donde se debe comprobar: a) El árbol cuyo derribo se pretende constituya una amenaza inminente, por peligro de caída, para los derechos de la persona poseedora o para las transeúntes (integridad, vida o su patrimonio), o bien pueda perjudicar alguna cosa. b) Derecho.

Si bien el ordenamiento jurídico concede el derecho de derribar árboles peligrosos, debe existir una causa justa para ello. Si se trata de un árbol, dada la normativa de protección ambiental vigente en el país, se requiere verificar que su corta o desrame sea realmente necesaria, por lo que se deben cumplir los presupuestos exigidos, para así evitar un derribo ilegal o innecesario. En ese sentido, aunque un árbol esté enfermo o con peligro de caída, si ese acto no afecta en realidad la integridad de las personas o su patrimonio, no debe autorizarse su derribo, pues no existe otro bien jurídico que tutelar y por el contrario, puede ser necesario para el equilibrio ambiental de los ecosistemas, dejar que se caiga por causas naturales. c) Interés actual: el bien que se pide se permita sea derribado, debe existir y mantenerse la situación de peligro inminente de caída, tanto cuando se plantea la demanda como cuando se emite la sentencia.

Hace ver, no debe ser esta vía procesal utilizada para resolver problemas derivados de relaciones de vecindad, por incumplimiento de normativa específica referida a la distancia mínima en que se pueden sembrar árboles en función de las colindancias, salvo lo que concierne al peligro o riesgo real de caída del árbol total o de las ramas (numerales 403 y 404 Código Civil). Los conflictos que se puedan generar por raíces y otros aspectos, que no constituyan factores que pueda provocar la caída inminente del árbol, deben ser discutidos a través de la vía procesal pertinente, que usualmente es un ordinario, para garantizar el debido proceso a las partes involucradas y por el tipo de prueba que usualmente se requiere para ello. Refiere, el criterio técnico emitido en este proceso (informe de funcionario de SINAC de Grecia N° SINAC-ACC-OG-inf-0475-2024), es insuficiente para demostrar que existe un peligro eminente o amenaza real del árbol de interés en este proceso.

Reseña lo anotado en tal donde se expuso: "No se encontraron al momento de la inspección, cargas dinámicas o estáticas que pongan en riesgo la estabilidad estructural del árbol. El árbol no presenta al momento de la inspección de campo ningún síntoma de afectación por patógenos. El árbol se encuentra ligeramente inclinado con rumbo sur-oeste, en dirección a la calle principal. Se localizaron algunas podas a nivel de ramas superiores, las cuales, fueron realizadas de manera incorrecta; sin embargo, se dio un adecuado proceso de recuperación o compartimentación de las áreas afectadas por la poda. Estas áreas afectadas desarrollaron adecuadamente Pared Residual para encapsular el daño y evitar la pérdida de vitalidad del árbol o el ingreso de patógenos. El tronco cuenta con tres ejes principales sanos. Se observó en el corte de una rama gruesa del tallo, que fue eliminada, un fluido de resina, lo cual, es normal en un proceso de recuperación del árbol ante una herida, la compartimentación se está desarrollando adecuadamente.

El cuello del árbol fue enterrado, a futuro si es posible que se genere pérdida de vitalidad del árbol, pues, los tallos no están adaptados para estar enterrados, y esto provoca el ataque de patógenos en ellos, ocasionando enfermedad y la inevitable pérdida de vitalidad de este. Posteriormente caída de ramas y del árbol. Este árbol tiene parte del tallo enterrado, y a un futuro, puede generar ingreso de patógenos en este, pues, el tallo del árbol, no es una estructura adaptada para estar enterrada". Al respecto, la parte recurrente combate que ese informe del especialista no demuestra que el árbol represente un peligro inminente de caída o peligrosidad. Sin que se adjuntaran otros elementos probatorios que permitan llegar a la conclusión emitida en la sentencia apelada. Agravia, se reconoce en la sentencia la inexistencia de certeza del momento en que podría caer el árbol, pero opta por anticiparlo, sin tomar en cuenta que en este tipo de proceso se requiere que la amenaza sea real y actual.

Es decir que el riesgo de caída sea inminente. Como ser vivo, resulta lógico que un árbol puede llegar a extinguirse por caída. Pero de no probarse que este suceso puede acontecer en cualquier momento actual, no debe procederse injustificadamente a adelantar la situación. Se argumenta media una ausencia de prueba eficiente que determine un riesgo actual que justifique la corta total del árbol. Por lo que no se cumple con los presupuestos del derribo y estaría afectando el ambiente, el paisaje biológico y preservación del ecosistema. Se solicita revocatoria de la sentencia recurrida y se rechace la presente demanda (expediente electrónico bandeja de escritos de fecha 06/12/2024 imagen 113 a 117 modo pdf).

VI- En la resolución apelada resuelve la pretensión de la actora [Nombre 001] de derribo del árbol alegando que representa un peligro y causa daños a su propiedad. En lo de interés, dentro del elenco de hechos probados se tubo por demostrado que el árbol de Guapinol está ubicado en la finca de la demandada, cerca de la vivienda de la actora, con ramas que se extienden sobre su techo y hacia el tendido eléctrico. Tiene medidas de 80 centímetros de diámetro, 11 metros de altura y copa de 16 metros de proyección. No se encontraron daños estructurales inmediatos, ni signos de enfermedad o afectación por patógenos en la inspección de campo. Se encontró el árbol se encuentra ligeramente inclinado hacia la vía pública y parte de su tallo está enterrado, lo que podría, a futuro, provocar la entrada de patógenos y la pérdida de vitalidad, con riesgo de caída de ramas o del árbol completo. Además, no se demostró que las raíces estén dañando muros de la propiedad de la actora, aunque sí se constató la proximidad de ramas al techo y al acceso de la casa.

Se funda la resolución en el artículo 108 del Código Procesal Civil, que permite el proceso sumario de derribo cuando un árbol constituye amenaza para derechos de poseedores, transeúntes o bienes públicos. En la resolución se analizó el contenido del informe técnico emitido por el SINAC de Grecia N° SINAC-ACC-OG-inf-0475-2024 y el reconocimiento judicial, del que se concluyó que si bien no encontró riesgo inminente, sí se advirtió un riesgo potencial futuro debido a la condición del árbol (tallo enterrado, posible pérdida de vitalidad y caída). Se expuso en la sentencia: “El cuello del árbol fue enterrado, a futuro si es posible que se genere pérdida de vitalidad del árbol, pues, los tallos no están adaptados para estar enterrados, y esto provoca el ataque de patógenos en ellos, ocasionando enfermedad y la inevitable pérdida de vitalidad de este. Posteriormente caída de ramas y del árbol.

Este árbol tiene parte del tallo enterrado, y a un futuro, puede generar ingreso de patógenos en este, pues, el tallo del árbol, no es una estructura adaptada para estar enterrada. Revisada la solicitud planteada en la demanda, una vez valorada tanto la prueba documental aportada a los autos, el reconocimiento judicial llevado a cabo, e informe de SINAC de Grecia, estima esta juzgadora que es menester ordenar medidas de seguridad. En este caso, procede ordenar la corta del árbol en cuestión. Ello, en virtud que si bien se indicó por los funcionarios de SINAC de Grecia que no se observan afectaciones fitosanitarias en el árbol, lo cierto es que sí se menciona por ellos que a futuro si es posible se genere pérdida de vitalidad del árbol (escuchar el audio del reconocimiento judicial) y en su informe indican: "pues, los tallos no están adaptados para estar enterrados, y esto provoca el ataque de patógenos en ellos, ocasionando enfermedad y la inevitable pérdida de vitalidad de este.

Posteriormente caída de ramas y del árbol. Este árbol tiene parte del tallo enterrado, y a un futuro, puede generar ingreso de patógenos en este, pues, el tallo del árbol, no es una estructura adaptada para estar enterrada" (ver informe incorporada en autos). Este árbol cuenta con una altura superior a los diez metros, y en su entorno hay casas habitadas, una calle y acera peatonal transitadas, así como tendido eléctrico. Estima esta juzgadora que es menester ordenar la corta de este árbol, a fin de evitar que a futuro pueda causar daños a personas que transiten por el lugar, o que habiten en las casas cercanas. Esto por la gran altura, por caídas de ramas, así como por la particularidad observada en cuanto se indicó por funcionarios de SINAC que a futuro se pueda dar el ingreso de patógenos porque el tallo no es una estructura adaptada para estar enterrada, aunado a que se observó en el reconocimiento judicial que las podas hechas no son adecuadas (escuchar audio).

Asimismo, por eventos de la naturaleza como fuertes vientos, y otros, se podría ocasionar caída de ramas o del mismo árbol. En el reconocimiento judicial se observó que el mayor peso de ramas está hacia la vía pública, y ramas sobre el ingreso y cercanas al techo de la casa de la actora, por lo cual se observa peligrosidad de mantener a este árbol en pie, por la situación que fue indicada en el informe de SINAC referida a la afectación a futuro de la estabilidad del árbol por encontrarse enterrado el cuello del tallo (escuchar audio de reconocimiento judicial y el informe escrito que consta en autos).” VII – Reclama la parte demandada apelante, se ha producido una inadecuada valoración de la norma de fondo en cuanto la necesidad de acreditarse el mal estado de la especie forestal, como presupuesto necesario para la procedencia del derribo. Del estudio de los autos ha de ser rechazado ese reclamo, debido a que se concluyó en la pieza apelada respecto al riesgo que, con fundamento técnico aportado si bien actualmente el árbol no presenta peligro inmediato, si existe una amenaza y riesgo futuro real de afectación a personas y bienes, en virtud de su altura, ubicación ( contiguos a viviendas y sobre vía pública) y la condición fitosanitaria potencialmente comprometida.

Se ponderó en la decisión apelada el interés de seguridad de los habitantes y transeúntes, la amenazada y riesgo de lo que acontecerá a futuro sin certeza del tiempo que esto tardará, en virtud del estado actual del árbol, así como la prevención de daños a la infraestructura y bienes de la actora. En este caso en particular, se ha anticipado mediante informe técnico científico lo que acontecerá, debida a que se encuentra el cuello del árbol enterrado, sin que estén adaptados para soportar esta condición y se indicó las consecuencias de esa condición en la estabilidad de la especie a futuro otorgando un riesgo moderado. Considera esta Cámara, lo anterior se estimó con la finalidad de tutelar la integridad física de las personas colindantes y transeúntes de la calle donde se inclina el árbol. Estimándose la decisión se encuentra justificada, cumpliéndose con la constatación de la amenaza descrita en el ordinal 108 del Código Procesal Civil de aplicación supletoria.

Al respecto se observa el informe técnico del SINAC referido y las fotografías que muestran el riesgo de caer el árbol sobre la vía pública produciendo daños en la integridad de personas y bienes, así como de las viviendas aledañas. Razón por la cual se cumplen los presupuestos del proceso de derribo dado la amenaza que representa mantener el árbol en pie bajo las condiciones de enterramiento de su cuello, identificadas en el informe técnico del órgano competente en materia forestal. De la lectura del mismo se indica en el acápite: “Infraestructuras cercanas” que “El árbol tiene dentro de su área de influencia por posible caída los siguientes elementos: Casa de habitación 1. Esta vivienda está ubicada al nort-este (sic) del árbol y tiene una tasa de ocupación alta, pues, al menos, hay una persona viviendo en el lugar las 24 horas del día. Casa de habitación 2. Esta vivienda se encuentra dentro de la misma propiedad donde está el árbol en cuestión, a una distancia de 3 metros de este.

Además, tiene una tasa de ocupación alta, pues, al menos, hay una persona viviendo en el lugar las 24 horas del día. Casa de habitación 3. Esta vivienda está ubicada al sur-oeste del árbol y tiene una tasa de ocupación alta, pues, al menos, hay una persona viviendo en el lugar las 24 horas del día. Carretera asfaltada: Esa carretera se encuentra frente al árbol, y posee una tasa de ocupación alta, pues, constantemente hay vehículos y personas transitando por el lugar. Tendido eléctrico: El tendido eléctrico se encuentre frente al árbol al otro lado de la carretera antes descrita. Acera peatonal: Esta acera se encuentra frente al árbol al otro lado de la carretera antes descrita y posee una tasa de ocupación alta, pues, constantemente hay personas transitando por el lugar”. Respecto a la categorización del riesgo se anotó: “Categorización del riesgo. De acuerdo con la valoración del riesgo aplicada al árbol su nivel de riesgo es moderado.

Con la única condición negativa, de estar parte del tallo del árbol enterrado, y que ello, a un futuro, puede generar ingreso de patógenos en este, pues, el tallo del árbol, no es una estructura adaptada para estar enterrada”. Cita el documento se emite la valoración del riesgo que representa el árbol utilizando el formulario de Evaluación Básica de Riesgo de Arbolado Urbano de la ISA (International Society of Arboriculture) y constan las fotografías. (imagen 78 a 82 modo pdf).

VIII- Para esta Cámara, bajo las condiciones citadas ha de ponderarse varios factores tales como el cumplimiento de derechos fundamentales de las personas en un proceso judicial, en resguardo del derecho a la vida humana, la integridad y la salud. Prevalencia que debe aplicarse bajo la dimensión del derecho al desarrollo sostenible, para asegurar el ejercicio de esos derecho citados en equilibrio con el derecho al ambiente sano y ecológicamente equilibrada. Lo anterior, acorde con el desarrollo de un Estado Social de Derecho (artículos 21, 45 y 50 de la Constitución Política). En caso de colisión de derechos de diversa categoría, debe ser resuelta dándole aplicación al de mayor rango (voto 972-90 de las 14:10 horas del 22 de agosto del 1990 de la Sala Constitucional de la Corte Suprema de Justicia). Ese mismo Alto Tribunal ha resuelto: " … El ejercicio de los derechos fundamentales, como la propiedad privada y la libertad de comercio no es irrestricto y deben limitarse por razones de bienestar social.

El derecho a un ambiente sano, a la salud e integridad física son derechos fundamentales que el Estado debe proteger" (voto 240.92 de las 9:00 horas del 31 de enero de 1992 y en este sentido voto 1488-92 de las 16:03 horas del 3 de junio del 1992). De tal forma que con lo resuelto en la sentencia apelada, en cuanto ordena la corta del árbol por la amenaza y ubicación del mismo, el riesgo medio debe integrarse con la amenaza apuntada a futuro por el enterramiento del cuello del árbol encontrado. Se han ponderado en la sentencia los derechos a la vida y seguridad de las personas que circundan el área del árbol objeto de este proceso de derribo. Respecto a la consideración de factores de riesgo o probabilidad de caída de una especie forestal o sus ramas por elementos externos al árbol este Tribunal ha resuelto en voto N° 2025000273 de las 12:05 horas del 26 de marzo del 2025: “De acuerdo con la Real academia española el vocablo ruinoso alude: “Que se empieza a arruinar o amenaza ruina”.

Según Cabanellas ruinosa es: “Que determina una ruina patrimonial”. En cuanto a ruina, el texto en cita, lo define jurídicamente así: “destrucción, caída de una cosa// Pérdida, perdición, destrozo.// Decadencia.// Pobreza tras fortuna o pasar modesto.// Estado de quien se queda sin bienes por desgracia, vicio o ajeno despojo; y esto, más por perfidia que por violencia” (Cabanellas, G. Diccionario enciclopédico de Derecho usual. Tomo VII. Heliasta: Buenos Aires). De tal forma cuando se le deba dar contenido al concepto de bien ruinoso para la emisión de la medida de seguridad se debe abordar con las pruebas si se presenta en la especie forestal un estado ruinoso. Desde la perspectiva técnica se deben ponderar diversos factores para arribar a la conclusión qué es un bien ruinoso o en mal estado. De acuerdo con el ingeniero forestal Erick Hernández Garzón, en el artículo científico “Evaluación del riesgo en árboles urbanos” (2020), los criterios de evaluación deben de considerar: “Árbol: Se recomienda levantar un registro de los defectos del árbol considerando raíces, fuste y copa, así como procurar descifrar la historia de vida desde el vivero hasta incluso las podas recibidas. • Condiciones del sitio: Hay que evaluar aspectos como topografía, exposición del árbol, lluvia, velocidad del viento, modificaciones del suelo como movimiento, compactación o levantamiento. • DIANA: determinar la persona o infraestructura que podría ser dañada.

Tomar en cuenta que hay objetos móviles e inmóviles” (p.72 https://www.ambientico.una.ac.cr/wp-content/uploads/tainacan items/5/31241/275_70- 76.pdf). De tal forma cuando se ponderen los aspectos en mención, debe de considerarse en el criterio técnico el estado del árbol; la condición del sitio donde se involucran aspectos de topografía y viento; así como la diana, que radica en la ponderación de personas o infraestructuras podrían ser dañadas, sean móviles o inmóviles. Es imperante comprender los alcances de las probabilidades de fallo y la categorización del impacto sobre el objetivo los cuales colaboran en la interpretación del informe técnico sobre las condiciones del sitio y la diana. En cuando a la categorización de la probabilidad de fallo se detallan en el documento en cita cuatro formas: “Inminente: La falla ha comenzado o es más probable que ocurra en el futuro cercano, incluso si no hay viento o una carga aumentada. • Posible: Podría ocurrir una falla, pero es poco probable bajo condiciones atmosféricas típicas.

Alta falla con vientos fuertes. • Probable: Se espera fallo bajo condiciones climáticas normales. • Improbable: No es probable que el árbol falle incluso en condiciones climáticas severas”. Relativo a la probabilidad de impacto son cuatro niveles: “Alta: Es probable que el objetivo se vea afectado • Medio: el objetivo puede o no verse afectado. • Bajo: No es probable que el objetivo se vea afectado • Muy bajo: La posibilidad de impactar un objetivo es remota” (Hernández Garzón (2020) p.74). Razona la citada fuente que una especie forestal se puede encontrar fitosanitariamente bien, pero fisuras en el fuste podrían determinar la probabilidad de fallo inminente o sea que podría ocurrir en un futuro cercano…… ). Otros datos que deben ser ponderados además del estado del árbol, son las condiciones del sitio… Cuando se pondera una medida de seguridad deberá analizarse el estado fitosanitario, las condiciones del sitio y la diana, según se explicó cada uno de estos aspectos supra.

En este caso la resolución apelada valora las condiciones del sitio y la diana”. De forma tal, en este caso deben igualmente considerarse los elementos de la ubicación del árbol respecto a la presencia de personas, transeúntes, vehículos y viviendas y la condición de encontrarse enterrado el cuello del árbol que traerá problemas y riesgos de caída que no es posible dejar de atender, al no tener certeza de cuando ocurrirá ese evento IX- Por las razones expuestas, con fundamento en los artículos 1, 2 y 54 de la Ley de Jurisdicción Agraria y 101 del Código Civil, ha de confirmarse en lo apelado la resolución N° 2024000216 de las dieciséis horas con dos minutos del veintinueve de noviembre del año dos mil veinticuatro.
