SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At veinte horas cuarenta y tres minutos on veinte de mayo de dos mil veinticinco.- PRECAUTIONARY MEASURE (MEDIDA CAUTELAR) ordered within the INTERDICT PROCEEDING (PROCESO INTERDICTAL) brought by EIDE, known as HEIDY CALDERÓN NAVARRO, of legal age, divorced, merchant, resident of Palmar Norte, identity card number seis - ciento ochenta y dos - seiscientos sesenta y cuatro; against SIXTO GUILLERMO AGUIRRE AGUIRRE, of legal age, single, resident of Palmar de Osa, identity card number cinco - ciento cincuenta y cuatro - ochocientos trece. Attorney Laura Beita Benavente serves as public defender for the plaintiff, and attorney José Ricardo Guevara Guevara, bar registration number tres mil quinientos ochenta y cuatro, serves as counsel of record for the defendant. The matter was processed before the Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores. This Tribunal hears the appeal (recurso de apelación) against the ruling issued at dieciséis horas doce minutos on siete de octubre de dos mil veinticuatro.

Judge Castro García authors the decision; and,

WHEREAS:

I.The appeal challenges decision N° 2024000333, issued at dieciséis horas doce minutos on siete de octubre de dos mil veinticuatro, which ordered the following precautionary measure: “In accordance with the reasons stated and the provisions cited, the following atypical precautionary measures (medidas cautelares atípicas) are APPROVED: ONE: Said gate shall remain closed, but Mr. Sixto Aguirre Aguirre must provide Ms. Eide Calderón Navarro with a copy of the keys to said padlock so that either she or third-party tenants or workers may perform livestock maintenance and care duties without being prevented from doing so. TWO: The keys referred to in the preceding clause must be delivered personally to Eide Calderón Navarro within the non-extendable period of tres días following service of this ruling. All of the foregoing is subject to the warning that, in the event of noncompliance, he may be investigated for the offense of Disobedience of Authority, as provided in article 314 of the Código Penal, without prejudice to any other criminal offenses that may also arise, for which those involved may be prosecuted. These measures do not prejudge what may be decided in subsequent proceedings and may be modified if the factual circumstances underlying their issuance change. Let notice be served.” (images 281 to 290, PDF mode).

II- Appeal. Defendant Sixto Aguirre Aguirre appeals the ruling, stating that assertions unsupported by sufficient evidence are made in the third whereas clause (considerando). He asserts the following grounds for disagreement: 1. Failure to conduct a prior site inspection or judicial viewing (reconocimiento) of the property (fundo). He alleges that the adjudicator failed to visit the parcel, an essential requirement under Agrarian Law for ascertaining the actual conditions at the site. He argues that, had the adjudicator visited the farm before issuing the measure, the adjudicator would have found that there are no livestock there, or that there are few; because the tenant’s livestock contracted brucellosis. This means that, from SENASA’s standpoint, the farm is under quarantine. He states that, had the judicial viewing been conducted, the adjudicator would have realized that the plaintiff’s statements are untrue, thereby revealing that the decision lacks adequate reasoning and that the ruling fails to comply with the rules of experience and reasoned judgment (sana crítica).

He states that the plaintiff claims to have cows about to calve, without having demonstrated through her livestock brand (fierro) that she has animals at the site. None of this was analyzed in the measure ordered. He adds that any livestock present might likewise be intended for fattening (steers) rather than breeding. This invalidates the automatic-reproduction argument stated in the appealed ruling, with which he disagrees due to the lack of evidence. If the farm has brucellosis, the pregnant cows are the ones that miscarry. As to the reasoning that maintenance must be performed on the farm to preserve ecological balance, he argues that this cannot be verified unless the adjudicator visits the site. 2. He characterizes the measure as inappropriate because it orders him to provide copies of the keys to third parties, thereby posing a risk to the defendant’s possession (posesión) by allowing access to unrelated persons.

He argues that it is contrary to the protective purpose of the measure because the tenant already had unrestricted access, since the appellant has lived at the site across from the gate for 12 years and has always opened it to provide access. He alleges that the order prejudged the matter and that allowing third-party involvement could constitute an unjustified disturbance of possession (perturbación posesoria). He disputes the appealed decision’s reasoning that it is reasonable for him to provide the plaintiff with a copy of the keys so that either she or third parties may carry them. He does not agree that the keys may be provided to unrelated persons who have nothing to do with his property, and notes that, curiously, nothing was mentioned regarding the loss of his pig when the plaintiff entered forcibly in the company of Mr. Deibis, whom he has reported to the Fiscalía de Osa. He states that he lives across from the gate and that, if copies of its keys are provided, no one can assure him that the person entering will not be a thief.

He argues that he has always opened the gate for the tenant who is there, if that is the basis of the plaintiff’s concern, since he has lived there for more than 12 years. He does not agree with providing copies to third parties, thereby leaving open the possibility of access by individuals who have nothing to do with the site. He argues that the plaintiff seeks to disturb his possession and that the ruling prejudges the merits of the matter (fondo del asunto). He requests that the precautionary measure be revoked and denied.

III.Inconsistency and omission in the assessment of evidence. Section 26 of the Agrarian Jurisdiction Law (Ley de Jurisdicción Agraria) provides that courts may declare proceedings null and void and order procedural steps to be repeated in order to correct irregularities that could affect the validity of the proceedings. In another respect, as regards appeals, section 60 of the aforementioned body of law states that the procedure shall be governed, as applicable, by the provisions of the Labor Code (Código de Trabajo). Article 474 of that body of law provides: “Procedural defects shall be corrected, remedied, or cured, and nullity shall be declared only when remediation is not possible.” Article 473 ibidem stipulates that the nullity of defective acts may also be declared sua sponte while the adjudicatory body retains jurisdiction, when the procedural violation is evident. Likewise, this Court has insisted on the principle of preservation of procedural acts (principio de la conservación de los actos procesales), in order to prevent unnecessary delays, except in cases where the omission or defect affects fundamental rights, including, among others, due process or the right of defense.

The respondent-appellant alleges that the interim judgment (sentencia cautelar) was issued without addressing his arguments and without a judicial inspection (reconocimiento judicial) to substantiate the reasoning set forth in the interim ruling that ordered interim measures (medidas cautelares). He alleges the omission and absence of fundamental evidence, such as the judicial inspection. In this specific case, the judgment contains defects that cannot be remedied at this stage, such as having been issued on the basis of circumstances alleged by the plaintiff, who sought interim relief (pretensión cautelar), without an on-site verification by the adjudicating judge that would have made it possible to confirm the existence of livestock and agricultural activity and the conditions under which that activity was conducted. Furthermore, the ruling did not address the appellant’s arguments when responding to the request for the interim measure, granting it without explaining why the respective judicial inspection requested by the plaintiff herself and subsequently by the defendant was not conducted.

Nor does the ruling cite the evidence from which it was concluded that cattle-raising activity existed or identify the type of activity, such that the judicial inspection whose absence is now challenged was unnecessary. That evidence and the findings from the judicial inspection are essential to determine whether the plaintiff has standing (legitimación activa) in these interim proceedings. The issue of the alleged presence of brucellosis on the property, raised by the respondent, was not analyzed, nor were the consequences that this circumstance could have as a source of infection. This matter was omitted entirely, even though the Trial Court (Juzgado de Instancia) was required to act to protect animal health, given the risk of the virus spreading and affecting the area in a manner that could impair the animal-health conditions of livestock located on or outside the property that is the subject of the principal proceedings.

To that end, it must apply the legal provisions governing livestock disease control, which has a robust legal framework comprising national and international rules enforced by specialized institutions. These include the General Law of the National Animal Health Service (Ley General del Servicio Nacional de Salud Animal) (Nº 8495), whose purpose is to regulate and protect animal health and veterinary public health and to govern the operation of the National Animal Health Service (Servicio Nacional de Salud Animal, SENASA). Its objectives are to control zoonoses and guarantee the safety of foods of animal origin, regulate veterinary medicines, animal feed, and genetic material, and establish sanitary measures for domestic movement, import/export, and quarantines. Nor may the current Animal Health Protection Regulations (Reglamento de Defensa Sanitaria Animal) be disregarded; these establish strict controls to prevent the introduction of exotic diseases through various control mechanisms, including the inspection of international and domestic animal transport, restrictions in infected areas and on the use of veterinary medicines, and epidemiological surveillance in coordination with health authorities.

Also applicable is the Cattle Control Law (Ley de Control de Ganado Bovino) (Nº 8799), which supplements the cited Ley 8495 with measures against cattle theft, as well as the international agreements concerning the standards of the World Organisation for Animal Health (Organización Mundial de Sanidad Animal, OIE) and the International Regional Organization for Agricultural Health (Organismo Internacional Regional de Sanidad Agropecuaria, OIRSA), which impose obligations on the State. Judges handling agrarian matters may not disregard such circumstances when adjudicating specific cases or fail to issue the appropriate rulings and coordinate with the competent institutions to establish the legally required controls. In environmental and public-health matters, judges must take a proactive approach in defending the overriding interests of the population. In this case, when considering the motion for reconsideration (revocatoria), the court failed to address the alleged presence of brucellosis at the site.

A reading of the challenged interim judgment shows that none of the aforementioned matters was assessed, in breach of the duty of reasoned analysis (deber intelectivo) established in section 54 of the Agrarian Jurisdiction Law. This violates the right of defense protected by the Constitution, as well as the duty of persons working in public service, including judges, to give effect to the right to a healthy environment by taking the actions necessary to ensure it (article 50 of the Constitution). As for the judicial inspection whose omission is challenged, the adjudicating judge did not conduct it before ruling on the interim measure. A review of the case file shows that the plaintiff, Calderón Navarro, filed an interdict action (demanda interdictal) against Aguirre Aguirre, claiming possession of the unregistered property that is the subject of these proceedings. After the order serving the complaint (auto de traslado) was served and the respondent denied the complaint, a filing styled as an urgent request for an interim measure was submitted (images 41 to 45 in PDF format).

It asked the court to order the defendant not to prevent the plaintiff, or anyone acting on her behalf, in any manner from moving and driving livestock through the disputed area. It also requested that he be ordered to provide a key to the padlock he had recently installed on the gate to the disputed area. The measure was based on the defendant’s refusal to provide her with a key to that gate so that livestock could be brought in by the plaintiff and by persons who lease and work on the property. She stated that several head of cattle were on the land, including one cow that was about to give birth, and that she urgently needed to enter the property, pass through the gate on which the defendant had installed a padlock, and bring in a vehicle carrying supplies for maintaining the property and the animals. She invoked the ancillary nature (instrumentalidad) of the measure and asserted compliance with the requirements of a prima facie case (apariencia de buen derecho), due to the need to enter through the gate to reach her property, where the defendant had installed a padlock for which she had no key.

She also cited his repeated statements that he would remove any livestock found on the property. Regarding the risk posed by delay (peligro de demora), she stated that the property is leased to other persons who may be unable to enter to care for their animals or bring in new livestock to graze on the property, and that those animals could perish if they do not receive the necessary care. She further cited the presence of a cow about to give birth and the need to bring in other cattle that would be acquired in the coming days. Regarding the residual nature (residualidad) of the relief, she stated that this was the only measure through which the plaintiff and third parties could gain entry to care for their animals and maintain the property. She also cited the need to bring in new specimens because of the upcoming auction at the site. She further stated that the property’s principal use is cattle grazing.

In responding to the application for the measure, the respondent argued that it should be denied because the purpose of such measures is to preserve the enforceability of any eventual final judgment entered in the proceedings, secure the financial outcome, or preserve evidence in advance (preconstituir prueba) for the adjudicating judge. He stated that no one who keeps livestock there has been prohibited from entering the property. The property is located on a public road and has a gate that remains closed for security because cattle were stolen from it in the past, and he therefore keeps it secured. Moreover, he lives at the entrance to the property, and it is untrue that he prevents entry. He stated that he has lived at the site for 12 years, openly and with the community’s knowledge, as its owner, and that there is only one entrance gate. The witness offered by the plaintiff, Mario Montoya, keeps livestock at the site and has never been prohibited from entering the property; the respondent watches for him when he arrives and opens the gate for him.

In fact, he helps him unload the animals he brings. Regarding the request that he provide a key, he stated that the plaintiff is neither the owner nor the possessor and that he does not agree to provide a key so that persons claiming to act on her behalf may enter the property, bring in livestock, and take advantage of a situation that occurred in the past, namely the matters cited in the answer to the complaint concerning the existence of an interdict proceeding (interdicto) and a criminal case involving Agrosur S.A. The respondent requested that the application be denied and asserted that a criminal case exists against the plaintiff and one of the witnesses whom she did present, arising from an incident in which they violently broke the chain, entered the property, removed livestock, and stole a pig that was confined in a pigpen. This occurred on 15 de agosto del 2024. He therefore cannot permit keys to be provided for the place where his belongings are kept.

He stated that he conducts agricultural activity and an agricultural operation there, which could be verified when the judicial inspection is conducted. He stated that the interim measure must protect agricultural production, which is what he carries out on the property, where he milks cattle and raises crops, chickens, pigs, plantains, square bananas, and cassava, comprising the agricultural activity from which he earns his livelihood. He stated that he has never had any problem with Mario Montoya. He asserted that the plaintiff did not establish the livestock brand (fierro) of the cow that was about to give birth, which she would be legally required to maintain in order to receive protection. Nor did she mention or submit a livestock-brand certificate showing that she owns animals. Registration of her signature would be a mandatory requirement for engaging in livestock activity. He maintained that the requirements for the interim measure were not met.

He challenged the credibility of the document submitted by the plaintiff stating that William Calderón Navarro is the owner of the property (images 66 to 67 in PDF format). The interim judgment of 7 de octubre del 2024 was then issued without any judicial inspection having been conducted. That decision was appealed, and in a separate filing the respondent submitted a statement that he had visited SENASA, where he was informed that brucellosis was present on the property and that the livestock had to be taken to the slaughterhouse because of the abortive effects suffered by infected animals. At the site, he found the remains of a livestock miscarriage and attached a photograph thereof. He stated that such miscarriage causes the disease to spread and that all bulls and cows had to be removed from the site. He requested that the interim measure be vacated due to the emergency, particularly because the appellant must monitor and control this situation. On those grounds, he also requested that the ordered measure be vacated and provided the contact telephone number of veterinarian Syn Ramírez Guzmán.

It states that the property must remain under quarantine, that no animals may enter, and that the arrival of the SENASA official is awaited (images 80 to 81, PDF view). The motion for reconsideration (recurso de revocatoria) was denied without assessing the arguments, and the matter was referred to this Court for consideration. Subsequently, the oral trial in the present proceedings on the merits was held on 22 de octubre del 2022, without it being possible to establish that a judicial inspection (reconocimiento judicial) was conducted on the property that the plaintiff claims to possess and where she keeps cattle, through which the matters raised by the party appealing the precautionary measure (medida cautelar) could be verified. It should be clarified that a judicial inspection was conducted on 22 de octubre del 2024 solely with respect to the condition of the gate located at the entrance to the property in question, which is insufficient to resolve the appeal of the precautionary measure (minutes at image 85, PDF view, and audio recordings in the case-file folder of the court of origin).

All these reasons inexorably require that the appealed precautionary ruling be declared null and void, so that the Trial Court may conduct a judicial inspection at the locations where the plaintiff claims to keep cattle, verify their existence and animal-health status (condición zoosanitaria), coordinate with the regional SENASA office regarding whether the property is under quarantine for brucellosis, and adopt the corresponding legally necessary measures. Given the manner in which this matter is resolved, it is unnecessary to address the grounds of appeal concerning the delivery of the keys and the need to maintain the property.

VI- Based on the foregoing reasons, the supplementary application (aplicación supletoria) of section 489 of the Labor Code (Código de Trabajo), Articles 1, 2, 6, and 26 of the Agrarian Jurisdiction Law (Ley de Jurisdicción Agraria), and Transitional Provision I of Ley 9343 and Transitional Provision II of Ley 9342, the appealed Resolution N° 2024000333 of dieciséis horas doce minutos del siete de octubre de dos mil veinticuatro is hereby vacated. The Trial Court (Juzgado de Instancia) shall conduct a judicial inspection (reconocimiento judicial) at the locations where the plaintiff alleges that she keeps cattle, verify their existence and animal health status (condición zoosanitaria), coordinate with the regional SENASA office regarding whether a brucellosis quarantine is in effect on that property, and take any necessary legal measures that may be appropriate. The interim measure (medida cautelar) shall subsequently be decided in light of the information gathered, the observations made during the judicial inspection, the information provided by the SENASA office regarding brucellosis, and the arguments raised in opposition by defendant Sixto Aguirre Aguirre.

POR TANTO:

Resolution N° 2024000333 of dieciséis horas doce minutos del siete de octubre de dos mil veinticuatro is hereby vacated. The Trial Court shall conduct a judicial inspection at the locations where the plaintiff alleges that she keeps cattle, verify their existence and animal health status, coordinate with the regional SENASA office to determine whether a brucellosis quarantine is in effect on that property, and take any necessary legal measures that may be appropriate. The interim measure shall be decided in light of the evidence in the proceedings, the information gathered, the observations made during the judicial inspection, the information provided by the SENASA office regarding brucellosis, and the arguments raised in opposition by defendant Sixto Aguirre Aguirre.

SIXTO GUILLERMO AGUIRRE AGUIRRE VOTO N° N° 2025000428 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las veinte horas cuarenta y tres minutos del veinte de mayo de dos mil veinticinco.- MEDIDA CAUTELAR establecida dentro del PROCESO INTERDICTAL incoado por EIDE conocida como HEIDY CALDERÓN NAVARRO, mayor, divorciada, comerciante, vecina de Palmar Norte, cédula de identidad seis - ciento ochenta y dos - seiscientos sesenta y cuatro; contra SIXTO GUILLERMO AGUIRRE AGUIRRE, mayor, soltero, vecino de Palmar de Osa, cédula de identidad cinco - ciento cincuenta y cuatro - ochocientos trece. Actúa como defensora pública de la parte actora, la licenciada Laura Beita Benavente; y como abogado director de la parte demandada, el letrado José Ricardo Guevara Guevara, colegiado tres mil quinientos ochenta y cuatro. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores. Conoce este Tribunal del recurso de apelación contra la resolución de las dieciséis horas doce minutos del siete de octubre de dos mil veinticuatro.

Redacta la jueza Castro García; y,

CONSIDERANDO:

I.Se recurre la decisión N° 2024000333 de las dieciséis horas doce minutos del siete de octubre de dos mil veinticuatro que decretó como medida cautelar: “De conformidad con las razones expuestas y la normativa citada, se APRUEBAN las siguientes medidas cautelares atípicas: UNO: Se mantenga dicho portón cerrado pero deberá el señor Sixto Aguirre Aguirre una copia de llaves de dicho candado a la señora Eide Calderón Navarro para que ya sea esta o terceras personas arrendantes o trabajadoras puedan atender las labores de mantenimiento y cuido de ganado, sin que se vean impedidas. DOS: La llaves dispuestas en la cláusula anterior se deberá entregar personalmente a Eide Calderón Navarro, en el plazo improrrogable de tres días a partir de la notificación de esta resolución. Todo lo anterior, bajo apercibimiento de que en caso de incumplimiento, se le podrá investigar por el delito de Desobediencia a la Autoridad conforme lo dispone el artículo 314 del Código Penal, sin perjuicio, de otras figuras delictivas que también pudieran presentarse, pudiendo ser procesados por dicha causa. Tales medidas no prejuzgan sobre lo que en proceso posterior se podría decidir, pudiendo modificarse si varían las condiciones fácticas que sirvieron de sustento para el dictado de ésta. Notifíquese.” (imagen 281 a 290 modo pdf).

II- Apelación. El demandado Sixto Aguirre Aguirre recurre la resolución indicando que en el considerando tercero se realizan afirmaciones sin pruebas suficientes. Acusa como motivos de disconformidad los siguientes: 1. Falta de visita previa o reconocimiento al fundo. Acusa, se omitió realizar una visita a la parcela por la persona juzgadora, requisito esencial en el Derecho Agrario para conocer la realidad del lugar. Alega, si la persona juzgadora hubiera visitado la finca de previo a dictarse la medida, hubiera constatado no hay ganado o el que existe es poco; debido a que el ganado del inquilino resultó con la enfermedad de brucelosis. Lo que significa desde el punto de vista de SENASA, la finca se encuentra en cuarentena. Menciona, en caso de haberse realizado el reconocimiento se percataría de que lo indicado por la actora no resulta cierto, surgiendo una falta de fundamentación del fallo e incumplimiento de las reglas de la experiencia y sana crítica en lo resuelto.

Afirma, la actora señala contar con vacas prontas a parir, sin que demostrara con su fierro que tenga animales en el sitio. Todo lo cual no fue analizado en la medida dictada. Agrega, igualmente existe la posibilidad de que el ganado que hubiere sea de engorde (novillos) y no reproductivo. Lo que invalida el argumento de reproducción automática argumentado en la resolución recurrida con el que se encuentra disconforme por falta de pruebas. Si la finca tiene brucelosis las vacas preñadas son las que abortan. Respecto al razonamiento de la necesidad de brindar mantenimiento en la finca para mantener un equilibrio ecológico, se reclama, en tanto no se visite por la persona juzgadora el sitio, no es posible se verifique ese aspecto. 2. Califica la medida de inadecuada al ordenarle la entrega de copias de llaves a terceras personas, al ser un riesgo para la posesión del demandado, al permitir el acceso a personas ajenas.

Ser contrario a la finalidad cautelar, ya que el inquilino ya tenía acceso sin restricciones pues el apelante habita en el sitio frente al portón desde hace 12 años y siempre abrió el acceso. Acusa, con lo decretado se adelantó criterio y al permitirse la intervención de terceros, podría configurarse una perturbación posesoria injustificada. Refuta se razona en la decisión apelada que es razonable la entrega por su parte de copia de llaves a la actora para que las porte ella o terceras personas. Sin que se comparta que puedan serle entregadas a personas ajenas que no tengan nada que ver con su fundo y que curiosamente no se mencionara nada respecto a la pérdida del cerdo que tuvo cuando el actor ingresó en forma violenta en compañía del señor Deibis a quien tiene denunciado en la Fiscalía de Osa. Señala, habita frente al portón y al entregar copias de las llaves del mismo, nadie le asegura no sea un ladrón el que ingresa.

Argumenta, él siempre abre el portón al inquilino que está ahí, si es la razón de preocupación de la actora, pues vive ahí hace más de 12 años. No se encuentra de acuerdo con la entrega de copias a terceras personas dejando abiertas posibilidades a sujetos que no tienen nada que ver con el lugar. Argumenta la actora pretende perturbarle su posesión y con lo resuelto se adelanta el criterio del fondo del asunto. Se solicita la revocatoria de la medida cautelar y se rechace .

III.Incongruencia y omisión de valoración de prueba. El ordinal 26 de la Ley de Jurisdicción Agraria establece, los tribunales podrán declarar nulidades y disponer la reposición de trámites, con la finalidad de corregir irregularidades que pudieran afectar la validez del proceso. En otro orden, en materia recursiva, el numeral 60 del cuerpo legal en cita, señala el trámite se regirá en lo pertinente por las disposiciones del Código de Trabajo. El artículo 474 de ese cuerpo legal, expone, " Los vicios procesales deberán ser corregidos, subsanados o saneados y la nulidad se decretará, únicamente, cuando la subsanación no sea posible." . Estipula el artículo 473 ibidem, que la nulidad de los actos viciados también podrá declararse de oficio mientas subsista la competencia del órgano, cuando el quebranto procesal sea evidente. Igualmente este Tribunal ha insistido en el principio de la conservación de los actos procesales, con la finalidad de evitar retrasos innecesarios, salvo en aquellos casos que la omisión o defecto afecte derechos fundamentales, entre otros, como el debido proceso o el de defensa.

La parte accionada apelante acusa se ha dictado la sentencia cautelar sin atender sus argumentaciones ni existiendo un reconocimiento judicial que de fundamento a los razonamientos vertidos en la resolución cautelar que ordenó medidas cautelares. Acusando la omisión y ausencia de elementos probatorios fundamentales como el reconocimiento judicial. En el caso concreto, se observa vicios de la sentencia insalvables en esta instancia, como lo es haberse emitido una sentencia fundada en una realidad alegada por la parte actora que solicitó la pretensión cautelar, sin que mediara la verificación en el sitio por la persona juzgadora que permitiera constatar los elementos de existencia de ganado y actividad agraria y las condiciones en que se desarrollaba. Aunado a que en la resolución no se atendieron los razonamientos del apelante al contestar la petición de la medida cautelar, concediendo sin justificarse el motivo por el que no se realizó el respectivo reconocimiento judicial solicitado por la misma actora y posteriormente por el demandado.

Tampoco se citan en la resolución los elementos probatorios por los que se concluyó existía una actividad bovina y de que tipo, que hicieran innecesario el reconocimiento judicial que hoy se extraña. Esas probanzas y la constatación del reconocimiento judicial son fundamentales para tener por acreditada o no la legitimación activa de este proceso cautelar. No se analizó el tema de la existencia de la enfermedad de brucelosis alegado por la parte accionada en la finca ni las consecuencias que este hecho pudiera tener como foco de contagio. Se omitió en forma absoluta este aspecto, siendo obligación del Juzgado de Instancia actuar de conformidad con la procura de la sanidad de los animales, en virtud del peligro de diseminación de ese virus y la afectación en la zona que pueda afectar las condiciones zoosanitarias de los semovientes que se ubiquen dentro o fuera de la finca objeto del proceso principal.

Para ello debe acudir a las normas legales atinentes al control de enfermedades del ganado, que cuenta con un marco legal robusto que se nutre de normas nacionales e internacionales que son ejecutadas por instituciones especializadas. A saber la Ley General del Servicio Nacional de Salud Animal (Nº 8495), cuyo fin es la regulación y protección de la salud animal, la salud pública veterinaria y la operación del Servicio Nacional de Salud Animal (SENASA). Cuyos objetivos son el control de zoonosis y garantizar la inocuidad de alimentos de origen animal, regular medicamentos veterinarios, alimentos para animales y material genético, así como establecer medidas sanitarias para desplazamiento interno, importación/exportación y cuarentenas. Sin dejar de lado la vigencia del Reglamento de Defensa Sanitaria Animal, que establece controles estrictos para prevenir la introducción de enfermedades exóticas con diversos mecanismos de control entre los que se encuentran la inspección de transporte internacional y nacional de animales, las restricciones a zonas infectadas y uso de medicamentos veterinarios, así como la vigilancia epidemiológica en colaboración con autoridades sanitarias.

Igualmente la Ley de Control de Ganado Bovino (Nº 8799), que complementa la Ley 8495 citada con medidas contra el robo de ganado y la vigencia de Acuerdos Internacionales referidos a normas de la Organización Mundial de Sanidad Animal (OIE) y del Organismo Internacional Regional de Sanidad Agropecuaria (OIRSA), que imponen obligaciones del Estado. No le es posible a las personas juzgadoras de la materia agraria omitir este tipo de situaciones cuando tramitan casos concretos y dejar de resolver lo pertinente y coordinar con las instituciones competentes para establecer los controles de ley. En materia ambiental y de salud pública se requiere de las personas juzgadoras una actitud proactiva en defensa de intereses superiores de la población. En este caso, ante la revocatoria, el despacho omitió hacer referencia al tema de la brucelosis que alega existe en el sitio. De la lectura la sentencia cautelar recurrida, se denota no medió valoración alguna de los aspectos referidos incumpliendo el deber intelectivo propio del ordinal 54 de la Ley de Jurisdicción Agraria.

Tal aspecto resulta violatorio del derecho de defensa resguardado en la norma constitucional, así como del deber de las personas que laboran en la función pública, incluidas las juezas y jueces de dar contenido al derecho al ambiente ejecutando las acciones necesarias para su aseguramiento (artículo 50 constitucional). Respecto al reconocimiento judicial que se reclama no se realizó por la persona juzgadora de previo a resolver la medida cautelar. De la revisión del expediente se observa que interpuso demanda interdictal por la actora Calderón Navarro contra Aguirre Aguirre, donde se reclama la posesión sobre finca sin inscribir objeto de este proceso. Luego de notificado el auto de traslado y contestada la demanda de forma negativa por el accionado, se solicita una gestión que se denomina solicitud urgente de medida cautelar (imagen 41 a 45 modo pdf). Donde se le pide al despacho se ordene al demandado no impedir de ninguna manera a la actora o a la persona que lo haga en su lugar, el traslado y paso de los animales de ganado por el área en litis.

Así como se ordenársele facilite una llave del candado que instaló recientemente en el portillo del área en discusión. Se fundamenta la medida en que se ha negado el demandado en brindarle la llave de ese portillo para la introducción de ganado por parte de la actora y de personas que arriendan y trabajan en la propiedad. Señalando que en el fundo se encuentran varias cabezas de ganado, entre las que una se encontraba a punto de parir y requería con urgencia el ingreso a la propiedad, pasar por ese portillo donde el demandado instaló un candado, pasar con vehículo que traslade insumos para el mantenimiento de la propiedad y los animales. Invocó la instrumentalizad de la medida y cumplimiento de los presupuestos de apariencia de buen derecho, debido a la necesidad de ingresar con el portillo para llegar a su propiedad, donde se instaló un candado por el demandado del cual no tiene llave. Así como las constantes manifestaciones de que sacaría el ganado que se encontrara en la propiedad.

Sobre el peligro de demora menciona que se alquila la finca a otras personas que no logren ingresar para cuidar sus animales, introducir nuevos animales de ganado para pastar en la propiedad y la posibilidad de perecer tales en caso de no dar el mantenimiento necesario. Además, la existencia de una vaca a punto de parir y la necesidad de ingresar otras que se adquirirán en días próximos. Respecto a la residualidad se menciona es la única medida por la cual podría lograrse el ingreso de la actora, terceras personas para cuidar a sus animales y dar mantenimiento a la finca. Así como la necesidad de introducir nuevos especímenes, debido a la proximidad de la subasta del lugar. Visto además que la finca se dedica al pasto de ganado como actividad principal. A la audiencia de la medida la parte accionada argumenta debe denegarse debido a que la finalidad de las medidas es preservar el cumplimiento de una eventual sentencia definitiva que recaiga en el proceso y asegurar el resultado económico o bien preconstituir prueba para la persona juzgadora.

Estima que a ninguna persona de las que tienen ganado se le ha prohibido el ingreso a la finca. Misma que se ubica sobre calle pública y tiene un portón que se mantiene cerrado por seguridad, pues en el pasado fue sujeto de un robo de ganado y por ello la mantiene asegurada. Aunado a que habita en la entrada del inmueble, sin que sea certero que impida el ingreso. Reseña hace 12 años vive en el sitio a vista y paciencia de la comunidad y en condición de dueño, sólo existe un portón de ingreso. El testigo ofrecido por la actora Mario Montoya tiene ganado en el sitio y nunca se le ha prohibido entrar a la finca, él se mantiene atento cuando ingresa y le abre el portón. Ayudándole más bien por su parte a bajar los animales que lleva. Respecto a que debe entregar una llave menciona que la actora no es dueña ni poseedora y no está de acuerdo con entregar una llave para que ingrese a la finca personas que indiquen van en nombre de ésta, introduzcan ganado y se saque provecho de una situación ocurrida en el pasado, referida a los citados en la contestación de la demanda a la existencia de un interdicto y una causa penal que existió con la sociedad Agrosur S.A. y el accionado solicita el rechazo y aseveró que existe una causa penal en contra de la actora y uno de los testigos que sí aportó en donde de forma violenta reventaron la cadena e ingresaron a la finca, se llevaron un ganad, le robaron un cerdo que se encontraba encerrado en un chiquero.

Lo que sucedió en 15 de agosto del 2024. Por lo que no puede permitir la entrega de llaves del lugar donde están sus pertenencias. Indica tiene actividad agraria y explotación que podrá ser verificado cuando se realice el reconocimiento judicial. Menciona la medida cautelar debe tutelar la producción agraria y es lo que él desarrolla en la propiedad donde ordeña, tiene cultivos, gallinas, cerdos, plátanos, cuadrados yuca y toda una actividad agraria de la que subsiste. Indica con el señor Mario Montoya nunca ha tenido ningún problema. Señala que la actora no demuestra el fierro de la vaca que está pronta a parir que debería mantener por ley para poder ser tutelada. Tampoco menciona ni aporta certificación de marcas de ganado que demuestre es propietaria de animales. Cuya obligación sería como requisito obligatorio registrar su firma para la actividad ganadera. Estima no se cumplen los requisitos de la medida cautelar.

Niega credibilidad al documento aportado por la actora donde se indica que William Calderón Navarro es el dueño de la finca (imagen 66 a 67 modo pdf). De seguido se emite la sentencia cautelar del 7 de octubre del 2024 sin que se hubiera realizado reconocimiento judicial alguno. Se apela esa decisión y en escrito aparte se aporta por el accionado un escrito con manifestaciones de haber visitado SENASA donde se le indicó la finca en cuestión tiene presencia de brucelosis y que ese ganado debe de llevarse al matadero, por los efectos abortivos de los animales contagiados. Ubicó en el sitio en producto de aborto de ganado encontrado en el lugar del que adjuntó fotografía. Mencionando que el aborto es lo que genera la transmisión de esa enfermedad, debiendo sacarse todos los toros y vacas del lugar. Solicita se revoque la medida cautelar debido a la emergencia, máxime que el recurrente debe vigilar esta situación y el control.

Pide además por estos motivos se revoque la medida ordenada y refiere al teléfono de contacto de la doctora veterinaria Syn Ramírez Guzmán. Cita la finca debe estar en cuarentena, no deben ingresar animales y se está a la espera de que llegue el funcionario de SENASA (imagen 80 a 81 modo pdf). Se rechazó el recurso de revocatoria sin valorar las argumentaciones y se remitió a esta Instancia el conocimiento de esta. De forma posterior ser realizó el juicio oral del presente proceso de fondo el 22 de octubre del 2022, sin que se logre constatar se haya realizado reconocimiento judicial en la finca que alega la actora tiene en posesión donde mantiene ganado, del cual se pueda constatar los aspectos reclamados por la parte recurrente de la medida cautelar. Aclarando si se realizó el reconocimiento judicial el 22 de octubre del 2024 solamente respecto a las condiciones del portón ubicado en la entrada de la finca en cuestión, lo que resulta insuficiente para dar solución a la apelación de la medida cautelar (minuta en imagen 85 modo pdf y audios del expediente carpeta del Juzgado de origen).

Todas esas razones conllevan ineludiblemente a decretar la nulidad de la resolución cautelar apelada a fin de que el Juzgado de Instancia proceda a realizar el reconocimiento judicial en los sitios donde alega la actora posee ganado, verificar su existencia, condición zoosanitaria y coordinar con la oficina de SENASA de la región sobre la existencia o no de cuarentena por brucelosis en esa propiedad y tomarse las medidas legales necesarias que correspondan. Se omite, dada la forma en que se resuelve, atender los agravios de la entrega de llaves y la necesidad de mantenimiento de la finca por innecesario.

VI- Con fundamento en las razones expuestas, la aplicación supletoria del numeral 489 del Código de Trabajo, artículo 1, 2, 6 y 26 de la Ley de Jurisdicción Agraria, y los transitorios I de la Ley 9343 y II de la Ley 9342 en lo apelado se anula la resolución N° 2024000333 de las dieciséis horas doce minutos del siete de octubre de dos mil veinticuatro. Proceda el Juzgado de Instancia a realizar el reconocimiento judicial en los sitios donde alega la actora posee ganado, verificar su existencia, condición zoosanitaria y coordinar con la oficina de SENASA de la región sobre la existencia o no de cuarentena por brucelosis en esa propiedad y tomarse las medidas legales necesarias que correspondan. Para posteriormente resolver la medida cautelar considerando la información recabada, lo observado en el reconocimiento judicial, lo que fuera indicado por la oficina de SENASA respecto a la brucelosis y los argumentos de oposición del demandado Sixto Aguirre Aguirre.

POR TANTO:

Se anula la resolución N° 2024000333 de las dieciséis horas doce minutos del siete de octubre de dos mil veinticuatro. Proceda el Juzgado de Instancia a realizar el reconocimiento judicial en los sitios donde alega la actora posee ganado, verificar su existencia, condición zoosanitaria y coordinar con la oficina de SENASA de la región a fin de verificar sobre la existencia o no de cuarentena por brucelosis en esa propiedad y tomarse las medidas legales necesarias que correspondan. Resuélvase la medida cautelar considerando los elementos del proceso, la información recabada, lo observado en el reconocimiento judicial, lo que fuera indicado por la oficina de SENASA respecto a la brucelosis y los argumentos de oposición del demandado Sixto Aguirre Aguirre.
