SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At sixteen hours fourteen minutes on the ninth of May of two thousand twenty-five.- SUMMARY PROCEEDING FOR TREE REMOVAL filed by ELENA QUESADA ÁLVAREZ, of legal age, married once, educator, identity card one- one thousand two hundred three- seven hundred eighty-two, resident of Florida, United States of America, represented by her unlimited-sum general power of attorney Maricruz Quesada Álvarez, of legal age, married once, homemaker, identity card one-one thousand forty-three-seven hundred twenty-three, resident of San Rafael de Esparza; against UNKNOWN. Attorney Ana Hernández Steller, public defender, appears representing the plaintiff. Processed before the Agrarian Court of the Third Judicial Circuit of Alajuela (San Ramón).
Judge Castro García writes; and,
CONSIDERING:
I-Based on Article 578 of the Labor Code, applied supplementarily by express reference of ordinal 26 of the Law of Agrarian Jurisdiction of the repealed Law of Agrarian Jurisdiction applicable to this matter (Transitory I of Law 9609), on its own motion and for purposes of enforceability, VOTO N° 2025000359 of ten hours thirty minutes on the twenty-fifth of April of two thousand twenty-five is added, which in its operative part ordered: “… This Tribunal orders the Central Conservation Area Biosphere Reserve Central Volcanic Mountain Range San Ramón Office of SINAC to provide technical support (acompañamiento técnico) to Elena Quesada Álvarez personally or to whomever she designates, so that once trees 2 and 4 have been removed, that environmental authority shall technically determine the species, quantity, and site for substituting the species removed due to failure risk (riesgo de fallo) in order to restore the ecosystem. Likewise, that at the moment of removal (derribo) of both and the pruning (poda) of the remaining trees, pertinent technical measures shall be taken to prevent harm to wildlife (fauna) that may be found in the trees and their branches, and if necessary, the plaintiff shall be determined to move the animals that are found inhabiting them to the same site. The measures and technical recommendations issued for the authorized felling (tala) in the resolution remain in force”, it should be read and this Chamber adds: The trial court shall proceed to issue a writ to the Conservation Area Central Conservation Area Biosphere Reserve Central Volcanic Mountain Range San Ramón Office, regarding technical support (acompañamiento técnico) to the party to carry out the pruning (podas) and tree removals (derribos), the substitutions and location ordered for the forest species, and the movement of any wildlife (fauna) that may be found at the site. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas catorce minutos del nueve de mayo de dos mil veinticinco.- PROCESO SUMARIO DE DERRIBO DE ÁRBOL interpuesto por ELENA QUESADA ÁLVAREZ mayor, casada una vez, educadora, cédula uno- mil doscientos tres- setecientos ochenta y dos, vecina de Florida de Estados Unidos, representada por su apoderada generalísima sin límite de suma Maricruz Quesada Álvarez mayor, casada una vez, ama de casa, cédula uno-mil cuarenta y tres-setecientos veintitrés, vecina de San Rafael de Esparza; contra IGNORADO. CONSIDERANDO:
I-Con fundamento en el artículo 578 del Código de Trabajo aplicado supletoriamente por remisión expresa del ordinal 26 de la Ley de Jurisdicción Agraria de la Ley de Jurisdicción Agraria derogada aplicable a este asunto (Transitorio I de Ley 9609), de oficio y para efectos de la ejecutividad se adiciona el VOTO N° 2025000359 de las diez horas treinta minutos del veinticinco de abril de dos mil veinticinco que en la parte dispositiva se dispuso: “… Se ordena por este Tribunal al Área de Conservación Central Reserva de Biosfera Cordillera Volcánica Central Oficina de San Ramón del SINAC, brinde el acompañamiento técnico a Elena Quesada Álvarez en forma personal o a quien la misma designe, para que una vez eliminados los árboles 2 y 4 esa autoridad ambiental determine técnicamente en cuanto a especie, cantidad y sitio para sustituir las especies eliminadas por riesgo de fallo a fin de restaurar el ecosistema. Igualmente que al momento del derribo de ambos y la poda de los restantes árboles, se tomen las medidas técnicas pertinentes para evitar el daño a la fauna que pueda encontrarse en los árboles y sus ramas y si es necesario determinen a la actora sean movilizados los animales que se encuentren habitando en los mismos, en el mismo sitio. Quedan vigentes las medidas y recomendaciones técnicas emitidas para la tala autorizada en la resolución”, debe leerse y se adiciona por esta Cámara: Proceda el juzgado de instancia a emitir oficio al Área de Conservación Área de Conservación Central Reserva de Biosfera Cordillera Volcánica Central Oficina de San Ramón, respecto al acompañamiento técnico a la parte para realizar las podas y los derribos, las sustituciones y ubicación ordenadas de las especies forestales y las movilizaciones de la fauna que pudiera encontrarse en el sitio.
