EL ESTADO N° 2025003064 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, at fourteen hours and four minutes on veintiocho de Marzo del dos mil veinticinco.- Ordinary proceeding (proceso de conocimiento) brought by TURISMO CURÚ, SOCIEDAD ANÓNIMA, represented by its general attorney-in-fact with full powers (apoderado generalísimo), Luis Schutt Valle, identity card N° 1-733-413, and its special litigation attorney-in-fact (apoderado especial judicial), Walter Soto Mora, professional license N° 12859; against the SISTEMA NACIONAL DE AREAS DE CONSERVACIÓN (hereinafter, “SINAC”), represented by its special litigation attorney-in-fact, Deifilia Davila Ruiz, professional license N° 8921, and EL ESTADO, represented by State Attorney Susana Fallas Cordero, professional license N° 9669.-
Whereas:
Regarding the underlying legal issue, it notes that the Refugio Nacional de Vida Silvestre Curú was created by Decreto Ejecutivo N° 14378-C, article 2 of which provides that hunting and any alteration of the site’s natural conditions are prohibited, and that even visits by private individuals require written permission from the Administration; paragraph 3 provides that persons residing at the site may continue their everyday activities, provided that those activities are consistent with the purposes for which the refuge was created.
Regarding the concept of the management plan, it states that:
It invokes, among others, artículo 82 of the Ley de Conservación de la Vida Silvestre, which, in its current version, provides in its final paragraph that all persons wishing to carry out activities or projects on publicly or jointly owned property must obtain authorization from SINAC, and an environmental impact assessment (evaluación de impacto ambiental) must be conducted at the interested party’s expense. It argues that, pursuant to numeral 73 of the Ley de la Zona Marítimo Terrestre, that law does not apply to the maritime-terrestrial zone (zona marítimo terrestre) included within national parks and equivalent reserves, for which reason:
Finally, it maintains that the challenged act is lawful because it constitutes an exercise of environmental protection (tutela ambiental), stating:
The State’s counsel then asserts that, in the area at issue, “(...) the official demarcation was published in the Official Gazette La Gaceta No. 66 of 3 de abril de 2014 (notice No. 2013-06, attached), 7 years ago. In any event, the arguments concerning the placement of boundary markers (amojonamiento) are irrelevant to these proceedings because artículo 152 of the Reglamento a la Ley de Conservación de la Vida Silvestre, Decreto No. 32633 del 10 de marzo del 2005, authorizes the Sistema Nacional de Áreas de Conservación (SINAC) to grant use permits (permisos de uso) solely within the restricted zone (zona restringida): ‘Artículo 152.- SINAC may grant use permits in the Zona Marítimo Terrestre (restricted zone) located within the boundaries of State-Owned and Mixed-Ownership Refuges, pursuant to artículo 82 of the Ley de Conservación de la Vida Silvestre, Nº 7317, artículo 18 of Ley Forestal 7575, and artículo 11 of the Reglamento a la Ley Forestal, Decreto Ejecutivo 25721-MINAE, and other related laws.’ (...) Accordingly, under the principle of legality (principio de legalidad) governing the actions of the Public Administration, permits may not be granted for the private use or exploitation of the public zone (zona pública) of a Wildlife Refuge, which is what is being sought.
As regards the adjacent restricted zone, if it were true, as alleged in the first and third statements of fact, that it is registered in the name of a legal entity (a situation of an exceptional nature whose legitimacy must necessarily be proven by the private party), the State could not grant use permits there, since such a permit is a legal mechanism for the use of the public domain (dominio público).” Later, regarding the merits, it states that “(...) The area of the Refugio Nacional de Vida Silvestre Curú to which administrative act (acto administrativo) ACT-OR-DR-781-2020 refers forms part of the Patrimonio Natural del Estado (artículos 13, 14 y 39, inc. i) of the Ley Forestal; numerales 32 y 38 of the Ley Orgánica del Ambiente; and judgments of the Sala Constitucional numbers 5399-93, 2777-98, 9158- 98 considerando I d), 2988-99, 3480-2003, 8928-2004, 8945-2005, 5975-2006, 17126-2006, 2063-2007, 16975, 17650 y 17659 del 2008, 16938-2011, 12973-2013 y 19776- 2014, among others).
Under the legal system currently in force, the Patrimonio Natural del Estado is part of the public domain (artículos 13 y 14 of the Ley Forestal and 261 y 262 of the Código Civil; decisions of the Sala Constitucional 2306-91, considerando IV; 2988-1999; 3821-2002, considerando VI; 2063-2007, considerando VI; 2408-2007, Considerando III; 8075-2008; 16975-2008; 17650-2008; 17659-2008 y 3113-2009, considerando V, among others; and judgments of the Sala Primera de la Corte Suprema de Justicia numbers 59-F-99, considerando IV; 189-F-S1-2011, considerando VI; 1469-F-S1-2011, considerando LVII; y 286-F-SI-2015, considerando VII). The fifty meters of the Zona Marítimo Terrestre measured from the ordinary high-tide line, now referred to as the Public Zone, are also part of the public domain (artículos 1, 9, 10 y 11 of Ley No. 6043). The reservation in favor of the State, which has been maintained in our legislation, has been called the ‘constitutional principle of the inviolability of the Public Zone’ (principio constitucional de intangibilidad de la Zona Pública).” Regarding the factual circumstances of the specific case, it asserts that: “Furthermore, the compliance order (prevención) is factually grounded in the Inspection Report of 28 de enero de 2019 ACT-OR-DASP-104-2019, which appears at folios 2-9 of the administrative record (expediente administrativo).
The inspection was conducted by an interdisciplinary team of ACT officials: Norma Rodríguez Garro, a forestry engineer, in her capacity as Head of the Dirección de Áreas Silvestres Protegidas; Luis Mena Aguilar, head of the Lepanto Paquera subregion; and land-surveying engineer Fabián Bonilla Salguero, as recorded at folio 9. It is important to emphasize that the inspection was conducted in response to a complaint; the report also contains photographs corroborating the presence of the vehicles and infrastructure that Mr. Luis Schutt Valle, in his capacity as representative of Turismo Curú S.A., was ordered to remove from the Patrimonio Natural del Estado, as well as their location in relation to the boundaries of the Refuge, GPS points, and maps prepared by the land-surveying engineer using official information from the Instituto Geográfico Nacional. It is therefore evident that the complaint’s challenges to the technical assessment and the statement of reasons (motivación) for the administrative act, which are raised only superficially against this report, are entirely unfounded.
No technical evidence is provided to support the accusations made by the plaintiff’s representative, beyond his opinion and his interest in continuing the irregular commercial activities that he himself acknowledges in statement of fact XIII are conducted without a permit, to the detriment of public property over which he holds no rights. Likewise, the challenges to the demarcation of the public zone are entirely unfounded, because a digital placement of boundary markers for the public zone of playa Curú exists and was made official by the Instituto Geográfico Nacional through AVISO No. 2013-06 Delimitación de zona pública cantón de Puntarenas, published in La Gaceta No. 66 of 3 de abril de 2014. The Instituto Geográfico Nacional used the ‘Georeferenced Digital Demarcation’ methodology (Delimitación Digital Georreferenciada), pursuant to Decreto Ejecutivo No. 36642-MP-MOPT-MINAET ‘Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre’ of 28 de junio de 2011, to demarcate the public zone of the Zona Marítimo Terrestre, this being the official information of the competent authority (...)”.
It requests that the action brought be dismissed in all respects.- At the oral trial, the following arguments were presented. For the plaintiff: There is a Decree of 6 de abril de 1983 that created the Refugio de Vida Silvestre Curú. This provides an important starting point for development in the area, enabling the company to maintain offices in downtown Paquera to serve domestic and foreign tourists and to charge a fee so that they may enter the refuge, as established in the management plan (plan de manejo). Once the tourists enter the refuge, they engage in a tourism activity at sea. The management plan states that tourists may enter the Reserve and remain in the area after paying the applicable fee. It is because of the development undertaken by Luis Schutt that recognitions have been granted for 100% carbon neutrality, the blue flag, and several others. The foregoing makes it very clear that the maritime-terrestrial zone is not being encroached upon.
The measurements of the digital boundary markers are unclear, and the record refers to approximate measurements; it cannot be asserted that an encroachment exists in the absence of exact digital boundary markers. There are no specific measurements establishing where the Reserve begins and ends, and the exact measurements are unclear. If there is no evidence providing that clarity, it will not be proven that the ZMT is being encroached upon. For the SINAC representative: The subject matter of these proceedings is the unlawful occupation (ocupación irregular) of the public zone of Refugio Curú, created by the Decree published in La Gaceta. Wildlife refuges are administered by SINAC. The Ley de la Zona Marítima Terrestre establishes an exception for wildlife refuges. The problem is that the plaintiff conducts commercial activities in the public zone (although it is acknowledged that the principal activity takes place at sea).
It is not true that there is no precision, because the placement of boundary markers was published in “La Gaceta” in 2014. The Administration therefore carried out the eviction procedure (procedimiento de desalojo), which was duly served. No exploitation of the public zone is legally possible, and notice was given that the work must cease. Part of the subject matter of these proceedings concerns implementation of the management plan, in which the plaintiff’s participation is evident. The assertion that the property located in the public zone belongs to another company (Adelina) is unacceptable. The State’s counsel stated: The background and the first statement of fact in the complaint clarify that the Refuge includes a State-owned portion, consisting of the 50-meter zone measured from the ordinary high-tide line (public zone), and a private zone registered in the name of another company (Adelina S.A.).
There is the sea, then the public zone, and adjoining the public zone is the property registered in the name of Adelina S.A. It is in the public zone that the plaintiff carries out its commercial activity, and the plaintiff seeks a use permit for the strip of sand between the sea and Adelina’s property. It must be recalled that these acts are attributable to SINAC, as a deconcentrated body (órgano desconcentrado), and that the State is a defendant solely by virtue of artículo 12.2 of the Código Procesal Contencioso Administrativo (hereinafter, “CPCA”). The complaint is manifestly inadmissible and must be so declared.- VI) Manner in which this matter will be decided: First, brief reference will be made to the legal framework applicable to the creation and operation of national wildlife refuges (as a form of protected area (zona protegida)); next, the legality of the act of 2020 ordering the plaintiff company to cease its activities and remove property from the maritime-terrestrial zone will be analyzed; and finally, claims 2, 3, and 4 will be addressed, including, with respect to those claims, the issue of the time bar (caducidad de la acción) raised as an affirmative defense (excepción) by the State’s counsel.- Regarding the underlying legal issue, it must be borne in mind that the Refugio Nacional de Vida Silvestre Curú was created by Decreto Ejecutivo N° 14378-C del 25 de febrero de 1983, artículo 2 of which prohibits hunting and any alteration of the natural conditions of the location and even requires private visitors to obtain the Administration’s written permission; numeral 3 provides that persons residing at the location may continue their daily activities, provided that those activities are consistent with the purposes for which the refuge was created.- It must also be clear that, pursuant to the Decreto Ejecutivo, the RNVSC is located in the district of Paquera, province of Puntarenas, between Punta Quesera and Punta Curú.- It must also be borne in mind that, according to the foregoing list of proven facts (hechos probados), this wildlife refuge has the distinctive feature of having two owners and being located within both portions of the maritime-terrestrial zone: in the public zone (50 meters inland from the ordinary high-tide line), the State is the owner by operation of law; and in the restricted zone (from 50 meters to 200 meters inland from the sea), the owner is Adelina S.A.- The fact that the restricted zone of the maritime-terrestrial zone has an owner rather than a concession holder (concesionario), and that this owner is a corporation other than the legal entity that is the plaintiff herein—with Mr.
Luis Schutt Valle being a shareholder but not the legal representative of that corporation, having an established record in the conservation of natural resources, and being the son of its owners—is important because this is a matter on which the parties agree and which is not disputed in these proceedings.- Next, the legal framework of laws and regulations currently governing that national wildlife refuge must be reviewed, namely:
In the Ley Forestal, Article 18, as amended, provides: “Within the State Natural Heritage (Patrimonio Natural del Estado), the State may conduct or authorize research, training, and ecotourism activities, as well as activities necessary for the use of water for human consumption, in accordance with Article 18 bis of this law, once approved by the Minister of Environment and Energy, who shall determine, where appropriate, whether environmental impact assessments (evaluaciones del impacto ambiental) must be conducted, as established by the regulations to this law” (as amended by Article 1° of the Ley para autorizar el aprovechamiento de agua para consumo humano y construcción de obras conexas en el Patrimonio Natural del Estado, N° 9590 del 3 de julio de 2018).
Article 2 of the Reglamento a la Ley Forestal (as amended by Decreto Ejecutivo 35868 de 24/03/2010), provides, insofar as relevant: “For purposes of applying Ley Forestal Nº 7575 and its regulations, the terms listed shall have the following meanings: (...) n) Ecotourism (Ecoturismo): A set of actions aimed at maintaining a natural environment, with an emphasis on its biological, physical, and cultural features, through a controlled process that guarantees minimal environmental impact and is ecologically sustainable; it involves low-impact tourism activities; it benefits the local community and is satisfying for visitors. (...) r) Use Permits (Permisos de Uso): Authorizations to use portions of State-owned land for purposes that do not entail forest exploitation. (...) s) Management Plan (Plan de Manejo): The planning instrument that guides the management of a protected wildlife area (Área Silvestre Protegida) toward fulfillment of its long-term conservation objectives.
It is based on medium-term strategic courses of action and management objectives for the natural and cultural elements within the area, as well as on the relationship of the latter to their socio-environmental surroundings. It provides the basis for developing other planning and regulatory instruments for Protected Wildlife Areas (Áreas Silvestres Protegidas).”- Next, Article 2 of the specific regulations governing Article 18 of the Ley Forestal (regulated by Decreto Ejecutivo 35868 de 24/03/2010), provides: “On lands previously declared part of the State Natural Heritage, whether within or outside Protected Wildlife Areas, only training, ecotourism, and research activities shall be permitted. These activities shall be subject to the management plan of the Protected Wildlife Area and to other regulations established herein, as follows: // A- Within Protected Wildlife Areas// In the case of Protected Wildlife Areas, except for National Parks and Biological Reserves, ecotourism activities may be conducted solely and exclusively in the zones designated by the Sistema Nacional de Áreas de Conservación (SINAC), in accordance with the zoning (zonificación) of each Protected Wildlife Area.”- Article 39 of the Ley de Biodiversidad ((text amended by the sole article of Ley N° 9766 del 29 de octubre de 2019), provides: “The Consejo Nacional de Áreas de Conservación is hereby authorized to approve contracts and concessions for nonessential services and activities within State Protected Wildlife Areas, except for the responsibilities that this and other laws assign exclusively to the Executive Branch through the Ministerio de Ambiente y Energía (MINAE), such as protection and surveillance and the definition and monitoring of strategies, plans, and budgets for the conservation areas.
Under no circumstances may these concessions and contracts include authorization granting third parties access to elements of biodiversity or permitting the exploitation of natural resources; nor may they include the construction of private buildings.// Nonessential services and activities shall include parking facilities, restroom facilities, the administration of physical facilities, food services, shops, the construction and administration of trails, visitor management, and any others defined by the Consejo Regional del Área de Conservación through a technical study substantiating their inclusion.// These concessions and contracts may be granted solely and exclusively to community development associations, cooperatives, microenterprises registered with the Ministerio de Economía, Industria y Comercio (MEIC), or national nonprofit social organizations whose objectives include supporting the conservation of natural resources, which incorporate environmental management into their operations and the concession area, and whose legal status remains valid, provided that they are directly composed of and controlled by residents of the communities located within the area of influence of the respective Protected Wildlife Area.// The conservation areas shall provide these communities with extensive information regarding the services they decide to grant under concession and shall establish a registry of local organizations to ensure the greatest possible participation in contracting processes.// The Instituto Nacional de Aprendizaje (INA), in coordination with other public educational institutions and the respective municipalities, shall create training and technical instruction programs primarily directed toward communities located within the area of influence of Protected Wildlife Areas, so that they may benefit from this provision.// Concessionaires or permit holders shall submit satisfactory external audits performed within the last year, all as determined by the Consejo Regional del Área de Conservación.”- Finally, the General Management Plan (Plan General de Manejo) for the Refugio Nacional de Vida Silvestre Curú remains in force.
It was issued by the Consejo Nacional de Áreas de Conservación, promulgated through Acuerdo Nº 11 de la Sesión Ordinaria Nº 12-2017 del 18 de diciembre del 2017, published in the Diario Oficial del 24 de junio de 2019, and effective as of that same date, pursuant to Article 2°.- The background to that Plan includes the following: “SECOND: The Refugio Curú has a total surface area of 70 hectares, of which the State-owned area consists of the 50-meter beach strip extending from Punta Quesera to Punta Curú and a 150-meter strip running parallel to the public zone, comprising 70 hectares belonging to Adelina SA and forming part of Folio Real Nº 021115 Derecho 000.// THIRD: The Management Plan for Protected Wildlife Areas (ASP) is the guiding instrument for the effective administration and management of the natural and cultural elements present in those areas and the socio-environmental dynamics associated with them.
It is also the technical tool through which each ASP establishes management guidelines for use by managers, administrators, and stakeholder groups; therefore, the first bodies responsible for validating the management proposal are the authorities of the Conservation Area, together with the official public-participation bodies established therein, namely the Regional Councils and Local Committees, in accordance with Ley de Biodiversidad Nº 7788 (...) FIFTH: Through Acuerdo Nº 8 de la Sesión Extraordinaria Nº 02-2011 del 02 de mayo del 2011, CONAC agreed to amend Acuerdo Nº 17 de la Sesión Extraordinaria Nº 06-2008 del 04 de agosto del 2008 so that the zoning established in the General Management Plan would be published in full.// SIXTH: The process of preparing the Management Plan began in mayo del 2009 and concluded in marzo del 2014 through the creation of a planning and process-monitoring team composed in part of Empresa Adelina SA and ACT.
Specifically, the working team consisted of Federico Schutt, Refuge Administrator; Julieta Valle de Schutt, Legal Representative of ADELINA S.A; Adelina Schutt, Secretary of the Administrative Council of ADELINA S.A.; Lic. Norma Rodríguez, Manager of Protected Wildlife Areas; and Carolina Orozco, who was retained to facilitate the process. This team was responsible for approving the methodologies used to collect information, reviewing the assessments and final document, and participating in various workshops and presentations for outreach, validation, and official adoption of the Management Plan.// SEVENTH: The Comité Técnico del Área de Conservación Tempisque approved the Management Plan for the Refugio Nacional de vida silvestre Curú pursuant to Acuerdo Nº 5 de la minuta de reunión 16 de noviembre del 2013.// EIGHTH: The Management Plan was approved by the Consejo Regional del Área de Conservación Tempisque (CORACT) through Acuerdo Nº 2 de la sesión ordinaria N° 05-2014 del 11 de setiembre del 2014.// NINTH: CONAC reviewed the General Management Plan for the Refugio Nacional de Vida Silvestre Curú and, pursuant to Acuerdo Nº 11 de la Sesión Ordinaria Nº 12-2017 del 18 de diciembre del 2017, approved the General Management Plan and instructed the Executive Directorate of SINAC and the Directorate of ACT to undertake the corresponding procedures for its publication and official adoption.”- The following Conservation Objectives, Management Plan Objective, and Zoning were established in the RNVSC Management Plan (emphasis added):
“a) Refuge Conservation Objectives// The principal objective in creating the Refuge was to protect coastal vegetation and provide shelter for wildlife species, especially endangered species, including olive ridley and leatherback turtles, mantled howler monkeys and white-faced capuchins, hawks, eagles, great curassows, ocelots, pumas, and jaguarundis, among others.” “b) Management Plan Objective: Strengthen the Refuge’s joint administration processes (Adelina SA -SINAC) to ensure optimal management of the area’s natural resources and its sustainability.// Regulate and promote ecotourism activity within the Refuge to facilitate better use of tourist visits while minimizing impacts on natural resources.// Develop plans and actions to protect forested areas both within the Refuge and in the buffer zone (zona de amortiguamiento), in order to conserve the area’s biotic communities.// Plan actions to promote scientific research aimed at developing and/or maintaining suitable habitat for the biota.// Develop plans and actions for the management of wildlife species and the habitat necessary for their survival.// Establish a community education and awareness program focused on environmental improvement and biodiversity conservation and provide opportunities for environmental education within the area of influence.” “c) Refuge Zoning:
According to the MINAET - SINAC, 2004 guide for preparing and implementing management plans for Protected Wildlife Areas, zoning is the organization of the territory of a Protected Wildlife Area based on the value of its resources and its capacity to accommodate different uses. Clear and precise objectives and the corresponding regulations are established for these zones in order to minimize adverse impacts and ensure that use of the land is compatible with the conservation of the natural and cultural resources present in the area and with their relationship to the socio-environmental dynamics of the immediate surroundings. Zoning is based on the intensity of use assigned to each zone according to its biophysical characteristics. (...)
1 Restricted-use zone, approximately 63 hectares.
2. Public-use zone, approximately 10.5 hectares.
3 Special-use zone, approximately 2500 m2.
4. Protection zone, approximately 32 hectares.
5. Buffer zone (zona de amortiguamiento), approximately 1396 ha" Regarding the public zone (zona pública), which is the relevant zone for the resolution of this proceeding, the following was stated:
"2. Public-use zone (Zona de uso público) Definition This zone consists of sectors dominated by a natural environment where greater capacity may be developed to accommodate visitors who come to the site for recreation, education, research, and any other purpose compatible with the objectives for which the protected wildlife area was established. It consists of beach sectors and sites dominated by a natural environment where greater capacity may be developed to accommodate such visitors.
Objective To provide the general public with leisure and recreational areas through the enjoyment of natural, marine, and terrestrial resources.
Characteristics:
Area extending from the bridge over the estuary to the site where the cabins are located. Public services are concentrated at these sites, including cabins, restrooms, a souvenir shop, reception, rest areas, parking, a dining area, and use of playa Curú, which is located at the back of the bay and is approximately 40 meters wide and 900 meters long. The coconut palm (Cocos nucífera) is one of the most common plant species in the playa Curú sector and was introduced more than 30 years before the date on which the Refugio was established. Coconut palms are closely associated with other tree species that have regenerated naturally. This site is distinctive because many animal species can easily be seen arriving there, including raccoons, coatis, deer, mantled howler monkeys, and three groups or troops of white-faced monkeys, among others.
Sector:
From the bridge over the estuary to the cabin area and. Sector of the 150 private meters exclusively.
Low-impact activities such as walking, swimming, recreational areas, outdoor lunch areas, trails, use of grills, restrooms, showers, interpretive features, scientific instruments, wildlife observation.
Surveillance and control booth.
Guided horseback tours to Playa Quesera.
Parking only in the area designated for that purpose.
Parking adjacent to each cabin only for guests.
Construction of cabins (outside the 50 meters); only those currently existing, which are 6, are permitted. Likewise, the souvenir shop and reception.
Restrooms and showers, parking and dining area.
Collection of firewood, coconuts, and management of plants that are toxic or dangerous to visitors.
Bonfires. Nudism.
Camping.
Extraction of any natural resource.
Leaving organic waste is not permitted because of its effect on wildlife.
Travel along the beach using any type of motor vehicle is prohibited, except for vehicles required for protection, maintenance, or management of the Refugio, subject to prior authorization.
Wells may not be drilled.
Informal or permanent structures are not permitted unless required for surveillance and control purposes.
Parking areas and shops are not permitted.
Cutting vegetation is not permitted unless necessary for site-management purposes involving specific protection required for a wildlife species (as in the case of turtles), and may be performed only by the Administration.
Regarding the term of the management plan (Plan de Manejo), it was stated: "The management plan shall remain valid for a period of 10 years, with biennial evaluations. For its renewal, a participatory assessment of threats and weaknesses, objectives, vision, and work programs shall be conducted, as well as an assessment of the functioning of the management committee. This assessment shall be conducted approximately 6 months before its expiration, and the management plan shall be updated based on its results and renewed for an equal number of years."- VII) Regarding the claim seeking annulment (pretensión anulatoria) of official letter ACT-OR DR-781-2020 dated 8 de julio del 2020, issued by the Director of the ACT, consisting of an administrative act (acto administrativo) addressed to the plaintiff company ordering the cessation of commercial activities and giving notice for the immediate voluntary removal of infrastructure and other objects located within the 50 meters of the Public Zone, which forms part of the State Natural Heritage (Patrimonio Natural del Estado), in the RNVSC: the suspension of commercial activities was effective immediately, and the period for completing removal from the site was 90 calendar days from service of the act. That act was based on Articles 2 and 3 of Decreto Ejecutivo N° 14378, the RNVSC management plan, and inspection report ACT-OR-DASP-104-2019 dated 28 de enero del 2019. The following must be stated:
It should be noted that the question of whether the plaintiff company had erected structures in the Public Zone is not clear from the report prepared by the Instituto Geográfico Nacional (summarized in unproven fact 1); this does not deprive the administrative act restricting the plaintiff commercial company’s rights of its factual basis. That act is supported by the unauthorized conduct of activities not permitted by the management plan of the Reserva Nacional de Vida Silvestre Curú, such as frequently placing motor vehicles and boats in the Public Zone. The Public Zone is solely for the transit and presence of inhabitants, and ecotourism activities—such as those actually carried out there by the plaintiff—may be undertaken only with authorization from the Ministerio de Ambiente y Energía and only when they are among those permitted by Article 18 of the Ley Forestal (research, training, and ecotourism, as well as activities necessary for the use of water for human consumption) and Article 39 of the Ley de Biodiversidad (the provision of services and nonessential activities such as parking, restroom services, management of physical facilities, food services, shops, construction and management of trails, and visitor management).- It is noted that even if the existence of structures within the Public Zone had been proven, they would be illegal because, as the management plan likewise shows, buildings are not permitted at that location within the RNVSC.- It should be noted that, based on Article 18 of the Ley Forestal and the regulatory provisions cited above, as well as Article 39 of the Ley de Biodiversidad and, of course, the management plan, permits—necessarily obtained in advance—from the appropriate offices of the Ministerio de Ambiente and SINAC are always indispensable for carrying out activities, even ecotourism activities, in the Public Zone of the RNVSC.
No such permits had been obtained in this case, and that legal requirement could not be replaced by the fact that Mr. Luis Schutt Valle is a resident of the area, an environmental-conservation activist, and a shareholder of Adelina S.A. (the owner of the restricted zone forming part of the Refugio). It must be noted that there is no unrestricted right to engage in commerce (ecotourism) in the Public Zone (beach), which forms part of the State Natural Heritage, and that this activity may be conducted only with a license from the appropriate authority, a requirement that has not been met in this case.- Accordingly, the administrative act ordering the cessation of commercial activity in the Public Zone and granting a lengthy period (90 calendar days) for removing the plaintiff’s property from that location is properly supported by factual and legal grounds, and the challenge must therefore be dismissed.- It should further be noted that the rejection of the claim seeking nullity of the administrative act discussed above also entails rejection of the confirming acts issued to resolve the ordinary administrative appeals (recursos ordinarios) filed by the plaintiff herein, namely: resolution ACT-OR-DR-061-2020 at 9:15 a.m. on 4 de agosto del 2020, issued by the Dirección de la ACT, which rejected the preceding motion for reconsideration (recurso de revocatoria), and agreement N° 15 from extraordinary session N° 06-2021 of 27 de julio del 2021 of the Consejo Nacional de Áreas de Conservación, which dismissed the appeal (recurso de apelación).- VIII) Regarding claims 2), 3), and 4), which state: "2) That SINAC and the State be ordered to grant the permits required for the proper use of the public and restricted operating zones of the RNVSC, based on the public interest and subject to prior compliance with the requirements, which my client undertakes to satisfy.// 3) That SINAC and the State be ordered to appoint a special commission to study, update, and, if necessary, modify the management plan in accordance with the public interest, an analysis of the interests of regulated persons, and the circumstances that have existed in the area for many years.// 4) That SINAC be ordered to change the appointments of the officials involved in preparing and approving the management plan, as well as the participants in any committee which, for such purpose and according to the facts alleged, has been compromised in its continued supervision and planning, so that new professionals who are duly authorized and vested with the powers necessary to perform their duties are appointed."- Regarding this issue, the State’s counsel raised a statute-of-limitations defense (defensa de caducidad), arguing that the third claim is, in substance, a challenge to the management plan, which was published in junio del 2019 and therefore should have been challenged within the one-year period established by Article 37 CPCA, and that because the complaint was filed in noviembre del año 2021, the action is time-barred, as more than the one-year period established therein had elapsed.
However, after examining the complaint as filed, it is clear to this Court that the purpose of the third claim is not to seek annulment of that management plan, but solely to request that, when a future management plan is prepared, a special commission be appointed in a manner that safeguards the public interest and reflects the circumstances that have existed in the area for many years. Thus, the existing management plan is not being challenged, and consequently the one-year limitations period under Article 39 CPCA for challenging administrative acts of individual scope does not apply. In any event, the management plan is an administrative act of general application (acto administrativo de efectos generales) and therefore, pursuant to Article 37 ejusdem, is not subject to any limitations period and may be challenged for as long as it remains in force.- Having rejected the defense of expiration (caducidad), the Court observes that claim 2) concerns the future and seeks the lawful application of the requirements for granting use permits (permisos de uso) in the public zone (zona pública); it does not challenge a past situation that may have affected the rights of the plaintiff company.
Indeed, it was never disputed that the plaintiff herein had permission to conduct ecotourism activities at Playa Curú or the corresponding Wildlife Refuge (Refugio de Vida Silvestre); rather, the activities it conducted at the site were carried out without the MINAE license required by the Ley Forestal and the Ley de Biodiversidad. The only license held is the commercial license granted by the Concejo Municipal de Distrito de Paquera, which is insufficient to operate in the public zone that forms part of the State Natural Heritage (Patrimonio Natural del Estado). For that reason, the claim under discussion must also be denied, while noting that it is obvious that a request by an individual subject to the Administration (administrado) for a permit to use public-domain property (bien de dominio público), when submitted in the future, must be resolved in accordance with law.- As discussed above, the third prayer for relief (extremo petitorio) also concerns the future, when the RNVSC Management Plan (Plan de Manejo) expires (it remains in force for ten years, according to its own terms) and the corresponding commission is formed, and seeks to ensure that action is taken with due regard for the public interest, the interests of individuals subject to the Administration, and the existing circumstances in the area.
This claim must likewise be rejected because it concerns a future situation rather than a concrete impairment of the plaintiff company’s interests. Indeed, it was never even proven that approval of the Management Plan caused any actual or even potential harm to the plaintiff herein. When the new commission is formed, pursuant to the principle of accountability (principio de rendición de cuentas) (the doctrine of Article 11 of the Constitution), any person may obtain information, participate, and demand accountability regarding the actions taken in the manner requested.- Finally, the fourth claim, seeking modification of the appointments of the officials involved in preparing and monitoring the Management Plan, must be rejected for the simple reason that it has not been demonstrated that those persons (identified in the final proven fact) acted with the intention of harming the activities or interests of an ecotourism operator such as the plaintiff company, or engaged in misuse of authority (desviación de poder) to favor another company.
In any event, the RNVSC is a mixed protected area (zona protectora mixta) in which, beginning in 1983, a private party placed land that it owned outright (not under concession) under conservation management, thereby forming, together with the public zone constituting State Natural Heritage, a wildlife refuge (refugio de protección de la vida silvestre). It is therefore natural for representatives of the company owning the land located between 50 and 200 meters from the ordinary high-tide line (línea de pleamar ordinaria), namely Adelina S.A., to participate in the advisory body that assists in preparing and monitoring the Management Plan. In any event, the claim is moot for the simple reason that neither the representatives of that company nor the SINAC public officials serving on that commission make decisions by themselves, since management plans must be approved by the Consejo Nacional de Áreas de Conservación in order to have legal effect against third parties, as established in Articles 22, 23, and 28 of the Ley de Biodiversidad.- IX) In accordance with the foregoing, the defense of lack of legal right (falta de derecho) must be upheld and the complaint dismissed in its entirety.- X) The unsuccessful plaintiff company is ordered to pay the attorneys’ fees and litigation costs (costas personales y procesales) incurred by the co-defendants, pursuant to the prevailing-party costs rule under Article 193 of the CPCA.
Neither of the two grounds for exemption provided for in that provision is present: that sufficient grounds for litigation are evident, or that the judgment is issued on the basis of evidence that was unknown when the action was filed.- The corresponding amount for that item shall be determined during the judgment-enforcement stage (etapa de ejecución de sentencia), and statutory interest (intereses legales) shall be awarded on that amount (applying the six-month basic deposit rate of the Banco Nacional de Costa Rica, pursuant to Article 1163 of the Código Civil), from the date on which the order setting costs becomes final until the date of full and effective payment.-
Por tanto:
The defense of expiration is rejected, and the defense of lack of legal right is upheld. Consequently, the action brought by Turismo Curú, Sociedad Anónima against the Sistema Nacional de Áreas de Conservación and the Estado is dismissed. The unsuccessful plaintiff company is ordered to pay the attorneys’ fees and litigation costs incurred by the co-defendants. The amount corresponding to costs shall be determined during the judgment-enforcement stage, and statutory interest shall be awarded on that amount from the date on which the order setting costs becomes final until the date of full and effective payment. EL ESTADO N° 2025003064 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las catorce horas con cuatro minutos del veintiocho de Marzo del dos mil veinticinco.- Proceso de conocimiento de TURISMO CURÚ, SOCIEDAD ANÓNIMA, representada por su apoderado generalísimo Luis Schutt Valle, cédula de identidad N° 1-733-413 y su apoderado especial judicial Walter Soto Mora, carné profesional N° 12859; contra el SISTEMA NACIONAL DE AREAS DE CONSERVACIÓN (en adelante, "el SINAC"), representada por su apoderada especial judicial, Deifilia Davila Ruiz, carné profesional N° 8921 y EL ESTADO, representada por la procuradora Susana Fallas Cordero, carne profesional N° 9669.-
Considerando:
En cuanto al tema jurídico de fondo recuerda que el Refugio Nacional de Vida Silvestre Curú se creó mediante Decreto Ejecutivo N° 14378-C, que en su artículo 2 establece que queda prohibida la caza y cualquier alteración de las condiciones naturales del lugar, requiriendo incluso la visita de particulares, el permiso escrito de Administración y el numeral 3 que prevé que las personas residentes en el lugar podrán continuar con sus actividades cotidianas, siempre y cuando concuerden con los fines de creación del refugio.
Sobre el concepto del plan de manejo, menciona que:
Invoca entre otros el artículo 82 de la Ley de Conservación de la Vida Silvestre, que en su versión vigente establece en el último párrafo, que establece que todos aquellos que quieran desarrollar actividades o proyectos en proyectos de propiedad pública o mixta deben contar con la autorización del SINAC, debiéndose realizar una evaluación de impacto ambiental, por cuanto del interesado. Aduce que conforme con el numeral 73 de la Ley de la Zona Marítimo Terrestre, esa ley no es aplicable a la zona marítimo terresre que esté incluida en parques nacionales y reservas equivalentes, razón por la cual:
Finalmente sostiene la legalidad del acto impugnado por ser ejercicio de la tutela ambiental diciendo:
Luego, la representación estatal, afirma que en el sector de interés "(...) la delimitación oficial fue publicada en el Periódico Oficial La Gaceta No. 66 del 3 de abril de 2014 (aviso No. 2013-06, adjunto), hace 7 años. En cualquier caso, los alegatos sobre el amojonamiento carecen de interés en este proceso, por cuanto el artículo 152 del Reglamento a la Ley de Conservación de la Vida Silvestre, Decreto No. 32633 del 10 de marzo del 2005, otorga al Sistema Nacional de Áreas de Conservación (SINAC) la posibilidad de otorgar permisos de uso únicamente en la zona restringida: “Artículo 152.- El SINAC podrá otorgar permisos de uso, en la Zona Marítimo Terrestre (zona restringida) comprendida dentro de los límites de los Refugios de Propiedad Estatal y Mixta, de acuerdo al artículo 82 de la Ley de Conservación de la Vida Silvestre, Nº 7317, al artículo 18 de la Ley Forestal 7575 y el artículo 11 del Reglamento a la Ley Forestal, Decreto Ejecutivo 25721-MINAE y otras leyes conexas.” (...) De manera que, conforme al principio de legalidad que regula el accionar de la Administración Pública, no pueden otorgarse permisos para el uso o aprovechamiento privativo en la zona pública de un Refugio de Vida Silvestre, que es lo que se pretende.
En lo que se refiere a la zona restringida adyacente, si fuera cierto, como se afirma en los hechos primero y tercero, que está inscrita a nombre de una persona jurídica (situación de carácter excepcional y cuya legitimidad es de necesaria comprobación por el particular), El Estado no podría otorgar allí permisos de uso, ya que es una figura para la utilización del dominio público". Más adelante en cuanto al fondo se dice que "(...) El sector del Refugio Nacional de Vida Silvestre Curú al que se refiere el acto administrativo ACT-OR-DR-781-2020, forma parte del Patrimonio Natural del Estado (artículos 13, 14 y 39, inc. i) de la Ley Forestal; numerales 32 y 38 de la Ley Orgánica del Ambiente; y sentencias de la Sala Constitucional números 5399-93, 2777-98, 9158- 98 considerando I d), 2988-99, 3480-2003, 8928-2004, 8945-2005, 5975-2006, 17126-2006, 2063-2007, 16975, 17650 y 17659 del 2008, 16938-2011, 12973-2013 y 19776- 2014, entre otras).
Conforme al ordenamiento jurídico vigente, el Patrimonio Natural del Estado es de dominio público (artículos 13 y 14 de la Ley Forestal y 261 y 262 del Código Civil; votos de la Sala Constitucional 2306-91, considerando IV; 2988-1999; 3821-2002, considerando VI; 2063-2007, considerando VI; 2408-2007, considerando III; 8075-2008; 16975-2008; 17650-2008; 17659-2008 y 3113-2009, considerando V, entre otros; y sentencias de la Sala Primera de la Corte Suprema de Justicia números 59-F-99, considerando IV; 189-F-S1-2011, considerando VI; 1469-F-S1-2011, considerando LVII; y 286-F-SI-2015, considerando VII). También son de dominio público los cincuenta metros de la Zona Marítimo Terrestre a partir de la pleamar ordinaria, hoy denominados Zona Pública (artículos 1, 9, 10 y 11 de la Ley No. 6043). La reserva en favor del Estado, que se ha mantenido en nuestra legislación, ha sido denominada “principio constitucional de intangibilidad de la Zona Pública”.
En cuanto a las circunstancias de hecho del caso concreto afirma que: "Por otra parte, la prevención encuentra su motivación fáctica en el Informe de Inspección del 28 de enero de 2019 ACT-OR-DASP-104-2019, que consta a folios 2-9 del expediente administrativo, inspección realizada por un equipo interdisciplinario de funcionarios del ACT: Norma Rodríguez Garro, ingeniera forestal, en su condición de Jefa de la Dirección de Áreas Silvestres Protegidas, Luis Mena Aguilar, jefe de la subregión Lepanto Paquera, y el ingeniero topógrafo Fabián Bonilla Salguero, como consta en el folio 9. Es importante destacar que la inspección se realiza a partir de una denuncia; constan además en el informe las fotografías que corroboran los vehículos e infraestructura que se le previene remover del Patrimonio Natural del Estado al señor Luis Schutt Valle, en su condición de representante de Turismo Curú S.A., así como la localización de los mismos con respecto a los límites del Refugio, puntos de GPS, mapas; realizados por el ingeniero topógrafo a partir de información oficial del Instituto Geográfico Nacional.
De ahí que es evidente que los cuestionamientos de la demanda sobre el criterio técnico y la motivación del acto administrativo, que se esbozan de manera superficial contra este informe, no tienen ningún fundamento. No se aporta ninguna prueba técnica que respalde las acusaciones del representante de la actora, más allá de su opinión e interés en continuar con las actividades comerciales irregulares que el mismo reconoce en el hecho XIII carecen de permiso, en detrimento de bienes públicos sobre los cuales no ostenta ningún derecho. Asimismo, los cuestionamientos sobre la delimitación de la zona pública son totalmente infundados, ya que se cuenta con el amojonamiento digital de la zona pública de playa Curú, oficializado por el Instituto Geográfico Nacional en AVISO No. 2013-06 Delimitación de zona pública cantón de Puntarenas, publicado en La Gaceta No. 66 del 3 de abril de 2014. El Instituto Geográfico Nacional, utilizó la metodología de “Delimitación Digital Georreferenciada” conforme al Decreto Ejecutivo No. 36642-MP-MOPT-MINAET “Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre” del 28 de junio de 2011, para delimitar la zona pública de la Zona Marítimo Terrestre, siendo la información oficial de la autoridad competente (...)".
Pide que se rechacen en todos los extremos la acción intentada.- En el juicio oral se establecieron las siguientes argumentaciones: por la parte actora: existe un Decreto del 6 de abril de 1983, donde se creó el Refugio de Vida Silvestre Curú. Esto nos da un gran inicio de un desarrollo en la zona, para que la empresa tenga oficinas en Paquera centro atendiendo a los turistas nacionales y extranjeros, cobrando un canon, para que puedan ingresar al refugio como lo establece el plan de manejo. Una vez que los turistas ingresan al refugio, desarrollan una actividad de turismo dentro del mar. El plan de manejo dice que previo pago de los turistas, se puede ingresar a la Reserva y permanecer en la zona. Es por el desarrollo que Luis Schutt que se han otorgado reconocimientos de 100% carbono neutral, bandera azul y varios más. Con lo anterior se deja muy claro que no se invade la zona marítima terrestre.
Las mediciones de mojones digitales no están claras y en el expediente se hablan de medidas aproximadas y no se puede afirmar que existe una invasión si no existen mojones digitales exactos. No hay medidas específicas que determinan dónde se inicia la Reserva y dónde termina y no se tiene claro cuáles son las medidas exactas. Si no hay un escenario que nos de esa claridad y no se va a probar que se invade la ZMT. Por la representación del SINAC: el objeto de este proceso es por la ocupación irregular de la zona pública del Refugio Curú creado mediante el Decreto publicado en La Gaceta. Para los efectos de los refugios de vida silvestre que son administrados por el SINAC. La Ley de la Zona Marítima Terrestre establece la excepción en refugios de vida silvestre. El problema es que la actora realiza actividades comerciales en zona pública (aunque se reconoce que la actividad principal se realiza en el mar).
No es cierto que no exista precisión porque el amojonamiento fue publicado en "La Gaceta" desde el año 2014. Por eso la Administración realiza el procedimiento de desalojo que fue debidamente notificado. No existe un aprovechamiento posible en la zona pública, cuando se notificó la paralización de las obras. Parte del objeto de este proceso, es sobre el desarrollo del plan de manejo donde se evidencia la participación de la parte actora. No es de recibo que los bienes existentes en la zona pública sean propiedad de otra sociedad (Adelina). La representación estatal manifestó: en los antecedentes y en el hecho primero de la demanda, se aclara que el Refugio comprende una parte estatal que es la zona de 50 metros a partir de la pleamar ordinaria (zona pública) y una zona privada inscrita a nombre de otra sociedad (Adelina S.A). Está el mar, la zona pública y contiguo a la zona pública está la finca inscrita a nombre de Adelina S.A., Es en la zona pública donde el actor realiza su actividad comercial y el actor pide un permiso de uso en el franja de arena entre el mar y la finca de Adelina.
Hay que recordar que los actos son propios del SINAC, como órgano desconcentrado y que el Estado es parte demandada únicamente por el artículo 12.2 del Código Procesal Contencioso Administrativo (en adelante, "CPCA"). La demanda es abiertamente improcedente y así debe declararse.- VI) Forma en que se resolverá este asunto: Primeramente se hará una breve referencia al marco jurídico aplicable a la creación y funcionamiento de la figura refugios nacionales de vida silvestre (como forma de zona protegida), luego se analizará la legalidad del acto del del 2020, en que se ordenó la paralización de actividades a la sociedad actora, así como el retiro de bienes en la zona marítimo terrestre y finalmente el tema de las pretensiones 2, 3 y 4, analizando en cuanto a estas últimas el tema de la caducidad de la acción, que fue planteado por vía de excepción por la representación estatal.- En cuanto al tema jurídico de fondo hay que tener presente el Refugio Nacional de Vida Silvestre Curú se creó mediante el Decreto Ejecutivo N° 14378-C del 25 de febrero de 1983, que en su artículo 2 establece que queda prohibida la caza y cualquier alteración de las condiciones naturales del lugar, requiriendo incluso la visita de particulares, el permiso escrito de Administración y el numeral 3 que prevé que las personas residentes en el lugar podrán continuar con sus actividades cotidianas, siempre y cuando concuerden con los fines de creación del refugio.- También hay que tener claro que conforme el Decreto Ejecutivo, el RNVSC está ubicado en el distrito de Paquera, provincia de Puntarenas, entre Punta Quesera y Punta Curú.- Luego, hay que tener que conforme con el elenco de hechos probados anteriores, este refugio de vida silvestre tiene la particularidad que tiene dos propietarios y que está ubicado en las partes de la zona marítimo terrestre: en la zona pública (50 metros desde la línea de pleamar ordinaria hacia tierra firme), el propietario es de pleno derecho el Estado) y en la zona restringida (de los 50 metros a los 200 metros desde el mar hacia tierra firme), el propietario es Adelina S.A.- El tema que existe un propietario y no un concesionario de la zona restringida de la zona marítimo terrestre, y que ese propietario es una sociedad anónima que no es la persona jurídica aquí actora, siendo el señor Luis Schutt Valle, socio pero no representante legal de esa sociedad teniendo, teniendo don Luis trayectoria en tema de conservación de los recursos naturales y siendo hijo de los propietarios, es importante porque es tema en que existe consenso entre las partes y no es objeto de discusión en este proceso.- Luego hay que reseñar el marco legal de leyes y reglamentos que en la actualidad regulan ese refugio nacional de vida silvestre, a saber:
En la Ley Forestal, se observa el artículo 18 reformado que dice: "En el patrimonio natural, el Estado podrá realizar o autorizar labores de investigación, capacitación y ecoturismo, así como actividades necesarias para el aprovechamiento de agua para consumo humano, de conformidad con el artículo 18 bis de esta ley, una vez aprobadas por el ministro de Ambiente y Energía, quien definirá, cuando corresponda, la realización de evaluaciones del impacto ambiental, según lo establezca el reglamento de esta ley" (así reformado por el artículo 1° de la Ley para autorizar el aprovechamiento de agua para consumo humano y construcción de obras conexas en el Patrimonio Natural del Estado, N° 9590 del 3 de julio de 2018) El artículo 2 del Reglamento a la Ley Forestal (reformado por Decreto Ejecutivo 35868 de 24/03/2010), que en lo que interesa dice: "Para los efectos de la aplicación de la Ley Forestal Nº 7575 y su reglamento, los términos que se mencionan tendrán los siguientes significados: (...) n) Ecoturismo: Es un conjunto de actuaciones orientado a mantener un ambiente natural, con énfasis en sus rasgos biológicos, físicos y culturales; mediante un proceso controlado que garantice el mínimo impacto ambiental, es ecológicamente sostenible; involucra actividades turísticas de bajo impacto; es localmente beneficioso y satisfactorio para los visitantes (...) r) Permisos de Uso: Autorizaciones para el uso de partes de terrenos de propiedad Estatal, para fines que no conlleven el aprovechamiento forestal.
(...) s) Plan de Manejo: Es el instrumento de planificación que permite orientar la gestión de un área silvestre protegida hacia el cumplimiento de sus objetivos de conservación a largo plazo. Se fundamenta en líneas de acción estratégicas a mediano plazo y en objetivos de manejo para los elementos naturales y culturales incluidos dentro del área, así como en la relación de éstos últimos con su entorno socio-ambiental. Es la base para el desarrollo de otros instrumentos de planificación y reglamentación de la Áreas Silvestres Protegidas".- Luego, el artículo 2 del Reglamento específico al artículo 18 de la Ley Forestal (reglamentado por Decreto Ejecutivo 35868 de 24/03/2010), que establece: "En los terrenos previamente declarados como Patrimonio Natural del Estado, tanto dentro de las Áreas Silvestres Protegidas como fuera de ellas, sólo se permitirá realizar actividades de capacitación, ecoturismo e investigación, estas actividades estarán sujetas a lo establecido en el plan de manejo del Área Silvestre Protegida y otras regulaciones establecidas en la presente normativa, de la siguiente manera: // A- Dentro de las Áreas Silvestres Protegidas// En el caso de las Áreas Silvestres Protegidas a excepción de los Parques Nacionales y las Reservas Biológicas, las actividades de ecoturismo se podrán realizar única y exclusivamente en las zonas establecidas por el Sistema Nacional de Áreas de Conservación (SINAC), de conformidad con la zonificación de cada Área Silvestre Protegida".- El artículo 39 de la Ley de Biodiversidad ((texto reformado por el artículo único de la ley N° 9766 del 29 de octubre de 2019), que dice: "Se autoriza al Consejo Nacional de Áreas de Conservación para que apruebe los contratos y las concesiones de servicios y actividades no esenciales dentro de las áreas silvestres protegidas estatales, excepto el ejercicio de las responsabilidades que esta y otras leyes le encomiendan, exclusivamente, al Poder Ejecutivo por medio del Ministerio de Ambiente y Energía (Minae), tales como la protección y vigilancia, la definición, el seguimiento de estrategias, los planes y los presupuestos de lasáreas de conservación.
Estas concesiones y contratos en ningún caso podrán comprender laautorización del acceso a elementos de la biodiversidad en favor de terceros o la explotación de recursos naturales; tampoco la construcción de edificaciones privadas.// Los servicios y las actividades no esenciales serán: los estacionamientos, los servicios sanitarios, la administración de instalaciones físicas, los servicios de alimentación, las tiendas, la construcción y la administración de senderos, administración de la visita y otros que defina el Consejo Regional del Área de Conservación, mediante un estudio técnico que lo justifique.// Estas concesiones y contratos podrán otorgarse única y exclusivamente a asociaciones de desarrollo comunal, cooperativas, microempresas inscritas en el Ministerio de Economía,Industria y Comercio (MEIC) u organizaciones sociales nacionales sin fines de lucro que tengan objetivos de apoyo a la conservación de los recursos naturales, que incorporen lagestión ambiental dentro de los procesos y área concesionada y con su personería jurídica vigente, siempre que se encuentren integradas y controladas directamente por habitantes de las comunidades ubicadas en la zona de influencia de la respectiva área silvestre protegida.// Las áreas de conservación deberán brindar amplia información a estas comunidades sobre los servicios que decidan dar en concesión y establecer un registro de las organizaciones locales a efectos de garantizar la mayor participación posible en los procesos de contratación.// El Instituto Nacional de Aprendizaje (INA), en coordinación con otras entidades educativas públicas y las municipalidades respectivas, creará programas de capacitación e instrucción técnica orientados prioritariamente a las comunidades ubicadas en la zona de influencia de las áreas silvestres protegidas, a fin de que puedan aprovechar los beneficios de esta disposición.// Los concesionarios o permisionarios deberán presentar auditorías externas satisfactorias, realizadas en el último año; todo a juicio del Consejo Regional del Área de Conservación".- Finalmente, está vigente el Plan General de Manejo del Refugio Nacional de Vida Silvestre Curú, dictado por el Consejo Nacional de Áreas de Conservación, promulgado por Acuerdo Nº 11 de la Sesión Ordinaria Nº 12-2017 del 18 de diciembre del 2017, publicado en el Diario Oficial del 24 de junio de 2019 y con vigencia a partir de esa misma fecha, según el artículo 2°.- Como antecedentes de ese Plan, se tienen: "SEGUNDO: Que el Refugio Curú tiene una superficie de con un área total de 70 hectáreas, de las cuales posee un área estatal comprendida por los 50 metros de la playa desde Punta Quesera hasta Punta Curú y una faja de los 150 metros paralela a la zona publica, compuesta de 70 hectáreas, pertenecientes a Adelina SA, parte del Folio Real Nº 021115 Derecho 000.// TERCERO: Que el Plan de Manejo de las Áreas Silvestres Protegidas (ASP) es el instrumento orientador para una efectiva administración y manejo de los elementos naturales y culturales presentes en dichas áreas y de la dinámica socio ambiental ligada a éstos.
Además, es la herramienta técnica por medio de la cual cada ASP establece las directrices de manejo para el uso de los gestores, administradores y grupos de interés, por lo tanto la primera instancia que debe realizar la validación de la propuesta de manejo son las autoridades del Área de Conservación, así como las instancias oficiales de participación social establecidas en ellas, sean estas los Consejos Regionales y Comités Locales, de conformidad con la Ley de Biodiversidad Nº 7788 (...) QUINTO: Que el CONAC en Acuerdo Nº 8 de la Sesión Extraordinaria Nº 02-2011 del 02 de mayo del 2011 acordó modificar el Acuerdo Nº 17 de la Sesión Extraordinaria Nº 06-2008 del 04 de agosto del 2008, para que la zonificación definida en el Plan General de Manejo se publique integralmente.// SEXTO: El Proceso de elaboración del Plan de Manejo inició en mayo del 2009 y finalizó en marzo del 2014, mediante la conformación de un equipo de planificación y seguimiento al proceso conformado en parte por la Empresa Adelina SA y por el ACT.
Concretamente el equipo de trabajo estuvo integrado por Federico Schutt, Administrador del Refugio, Julieta Valle de Schutt Representante Legal ADELINA S.A, Adelina Schutt, Secretaria del Consejo Administrativo ADELINA S.A., Lic. Norma Rodríguez, Gerente de Áreas Silvestres Protegidas y Carolina Orozco, contratada para facilitar el proceso. Este equipo, tuvo la responsabilidad de aprobar las metodologías para la recopilación de la información, la revisión de los diagnósticos y documento final y la participación en diferentes talleres y presentaciones de socialización validación, y oficialización del Plan de Manejo.// SETIMO: Que el Comité Técnico del Área de Conservación Tempisque aprueba el Plan de Manejo del Refugio Nacional de vida silvestre Curú, según Acuerdo Nº 5 de la minuta de reunión 16 de noviembre del 2013.// OCTAVO: Que el Plan de Manejo fue aprobado por el Consejo Regional del Área de Conservación Tempisque (CORACT), mediante Acuerdo Nº 2 de la sesión ordinaria N° 05-2014 del 11 de setiembre del 2014.// NOVENO: Que el CONAC conoció el Plan General de Manejo del Refugio Nacional de Vida Silvestre Curú, de conformidad al Acuerdo Nº 11 de la Sesión Ordinaria Nº 12-2017 del 18 de diciembre del 2017, aprueba el plan General de Manejo e instruye a la Dirección Ejecutiva del SINAC y a la Dirección del ACT para que proceda con el trámite correspondiente para su publicación y oficialización".- En el Plan de Manejo del RNVSC, se tuvieron como Objetivos de Conservación; Objetivo del Plan de Manejo y Zonificación, los siguientes (los subrayados son propios):
"a) Objetivos de Conservación del Refugio// El objetivo principal de creación del Refugio ha sido la protección de la vegetación costera y el abrigo de especies de fauna silvestre en especial de aquella especies en peligro de extinción, las tortugas lora y Laud, monos congos y cariblancos, gavilanes, águilas, pavones, manigordo, pumas y león breñero entre otros" "b) Objetivo del Plan de Manejo: Fortalecer los procesos de administración conjunta (Adelina SA -SINAC) del Refugio para garantizar un manejo óptimo de los recursos naturales del área y la sostenibilidad del mismo.// Ordenar y promover la actividad eco-turística dentro del Refugio con el fin de propiciar un mejor aprovechamiento de la visita de los turistas y que el impacto a los recursos naturales sean mínimos.// Elaborar planes y acciones para proteger las áreas boscosas tanto del refugio como de la zona de amortiguamiento para conservar las comunidades bióticas del área.// Planificar acciones para propiciar la investigación científica para desarrollar y/o mantener un hábitat apropiado para la biota.// Elaborar planes y acciones para el manejo de especies faunísticas y hábitat necesario para la supervivencia de las mismas.// Establecer un programa de educación y sensibilización de las comunidades hacia el mejoramiento ambiental, la conservación de la biodiversidad y brindar oportunidades para una educación ambiental en el área de influencia" "c) Zonificación del Refugio:
Según la guía para la formulación y ejecución de planes de manejo de áreas silvestres protegidas del MINAET - SINAC, 2004 la zonificación viene a ser la organización del territorio de un área silvestre protegida en función del valor de los recursos y de su capacidad de acogida para los distintos usos, en los que se establecen objetivos muy claros y precisos y con la normativa correspondiente con el fin de minimizar impactos negativos y de asegurar un uso del espacio compatible con la conservación de los recursos naturales y culturales presentes en el área y su relación con la dinámica socio ambiental de su entorno inmediato. La zonificación se basa en la intensidad de uso de cada zona de acuerdo a sus características biofísicas. (...)
1 Zona de uso restringido, con 63 has aproximadamente.
2. Zona de uso pública, 10.5 has aproximadamente.
3 Zona de uso especial, 2500 m2 aproximadamente 4. Zona de protección, 32 has aproximadamente 5. Zona de amortiguamiento, 1396 has aproximadamente" En cuanto a la zona pública, que es la que interesa para la resolución de este proceso, se dijo lo siguiente:
"2. Zona de uso público Definición Esta zona está constituida por sectores dominados por un ambiente natural donde se puede desarrollar una mayor capacidad para acoger aquellos visitantes, que llegan al lugar con fines de recreación, educación, investigación y cualquier otro compatible con los objetivos de creación del área silvestre protegida. Esta está constituida por sectores de playa y sitio es dominados por un ambiente natural donde se puede desarrollar una mayor capacidad para acoger aquellos visitantes.
Objetivo Brindar al público en general áreas de esparcimiento y recreación a través del disfrute de recursos naturales, marítimos y terrestres.
Características:
Área que abarca del puente sobre el estuario al sitio donde están ubicadas las cabinas. En estos sitios se concentran los servicios al público, como cabinas, baños, tienda souvenir, recepción, sitios para descanso, parqueo, comedor y uso de playa curú la cual se localiza al fondo de la bahía tiene unos 40 metros de ancho y unos 900 metros de largo. El cocotero (Cocos nucífera) es una de las especies de plantas más comunes en el sector de playa Curú que fue introducida más de 30 años atrás de la fecha de creación del Refugio. Las palmeras de coco están muy asociadas con otras especies de árboles que se han regenerado naturalmente. Es un sitio donde tiene la particularidad de verse con facilidad la llegada de muchas especies de animales como los mapaches, pizote, venados, mono Congo y tres grupos o tropas de mono carablanca entre otros.
Sector:
Desde el puente del estuario hasta el área de cabinas y. Sector de los 150 metros privados exclusivamente.
Actividades de bajo impacto como caminatas, bañistas, áreas recreativas, zonas para almuerzo al aire libre, senderos, uso de asadores, sanitarios, duchas, elementos interpretativos, instrumentación científica, observación de fauna.
Caseta de vigilancia y control.
Tours a Caballo a Playa Quesera guiados.
Parqueo solamente en el área destinada para este fin.
Parqueo contiguo a cada cabina solamente para los huéspedes.
Construcción de cabinas.(fuera de los 50 metros) solo se permiten las que están actualmente que son 6. Igualmente la tienda - souvenir y recepción Sanitarios y duchas, parqueo y comedor Recolección de leña, cocos y manejo de plantas toxicas o peligrosas para los visitantes.
Fogatas, Nudismo.
Acampar.
La extracción de ningún recurso natural.
No se permite dejar residuos orgánicos por el efecto que causa sobre la fauna silvestre.
Queda prohibido el paso por la playa utilizando cualquier tipo de automotor, a excepción de los requeridos para el caso de protección, mantenimiento o de gestión del Refugio previa autorización.
No se podrán perforar pozos.
No se permiten construcciones informales o fijas a no ser que por motivos de vigilancia y control que se requiera.
No se permiten parqueos ni tiendas.
No se permite la corta de vegetación a no ser para fines de manejo del sito con fines de protección específica que se requiera con alguna especie silvestre (caso de las tortugas) y solo por parte de la Administración.
En cuanto a la vigencia del Plan, se dijo: "El plan de manejo tendrá una validez por un periodo de 10 años con evaluaciones bianuales. Para su renovación deberá de realizarse una evaluación participativa de las amenazas y de las debilidades, los objetivos, la visión y los programas de trabajo. Así como del funcionamiento del comité de manejo. Esta se tendrá que realizar unos 6 meses antes de su vencimiento y con los resultados de la misma se actualizará el plan de manejo dándole vigencia por un periodo igual de años".- VII) En cuanto a la pretensión anulatoria del oficio ACT-OR DR-781-2020 de fecha 8 de julio del 2020, el Director de la ACT, consistente en acto administrativo dirigido a la sociedad actora que ordena la paralización de actividades comerciales y prevención para el desalojo voluntario inmediato de infraestructura y otros objetos ubicados en los 50 metros de la Zona Pública, parte del Patrimonio Natural del Estado, en el RNVSC. La suspensión de actividades comerciales es de efecto inmediato y el plazo para cumplir el desalojo del lugar fue de 90 días naturales, a partir de la notificación del acto. Dicho acto se fundamentó en los artículos 2 y 3 del Decreto Ejecutivo N° 14378, el Plan de Manejo del RNVSC y en el informe de inspección ACT-OR-DASP-104-2019 del 28 de enero del 2019, debe decirse lo siguiente:
Por tanto:
Se rechaza la excepción de caducidad y se acoge la falta de derecho. En consecuencia, se declara sin lugar la acción de Turismo Curú, Sociedad Anónima contra el Sistema Nacional de Áreas de Conservación y el Estado. Se condena a la sociedad actora y vencida al pago de las costas personales y procesales en que hayan incurrido los codemandados. La fijación del monto que corresponda por costas se realizará en etapa de ejecución de sentencia, debiéndose reconocer los intereses legales sobre esa suma, desde la fecha en que se adquiera firmeza el auto de fijación de costas y hasta la fecha de su efectivo y completo pago.
