Decision: 2025-0348 Case file: 19-001360-0485-PE (6) CRIMINAL JUDGMENT APPEALS COURT. Second Judicial Circuit of San José. Goicoechea, at eight o’clock on veintiocho de febrero de dos mil veinticinco.
APPEAL (RECURSO DE APELACIÓN) filed in the present proceedings against [Nombre 001], who is of legal age, Costa Rican, holder of identification card number [Valor 001], born in Limón on 20 de octubre de 1954, son of [Nombre 002] and [Nombre 003], and currently residing in Limón Pococí, for the offense of INVASION OF A CONSERVATION AREA (INVASIÓN A UN ÁREA DE CONSERVACIÓN), to the detriment of NATURAL RESOURCES. Participating in the decision on the appeal are Judge Alejandra Valenciano Chinchilla and Judges Giovanni Mena Artavia and Edwin Esteban Jiménez González. Msc Yorleny Ching Cubero appeared before this Court on behalf of the Public Prosecutor’s Office (Ministerio Público), as did Criminal State Attorney Andrés Alfaro Ramírez and Wilberth Picado Portuguéz, private defense counsel for the accused.
PROCEDURAL BACKGROUND (RESULTANDO):
I.By judgment number 296-2024, issued at eleven hours and forty minutes on dieciséis de abril de dos mil veinticuatro, the Criminal Court of the Second Judicial Circuit of the Atlantic Zone ruled: “POR TANTO: In accordance with the foregoing and Articles 8.2 of the American Convention on Human Rights, 39 and 41 of the Political Constitution, 1, 9, 142, 184, 360, 361, and 363 to 366 of the Code of Criminal Procedure; 1, 30, 31, 45, and 227(a) of the Criminal Code; Articles 58(a) and 61(c), as well as Article 1045 of the Civil Code, the Court rules: By majority decision, applying the Universal Principle of In Dubio Pro Reo, defendant [Nombre 001] is ACQUITTED of all punishment and liability for the OFFENSE OF INVASION OF A PROTECTED WILDLIFE AREA (INVASIÓN DE ÁREA SILVESTRE PROTEGIDA), IN IDEAL CONCURRENCE (CONCURSO IDEAL) WITH THE OFFENSE OF USURPATION OF PUBLIC-DOMAIN PROPERTY (USURPACIÓN DE BIENES DE DOMINIO PÚBLICO), which he had been charged with committing to the detriment of natural resources.
The costs of the criminal proceedings shall be borne by the State. The civil action for damages (acción civil resarcitoria) brought by LA PROCURADORIA GENERAL DE LA REPÚBLICA against civil defendant [Nombre 001] is dismissed in its entirety. The private criminal complaint (querella) filed by LA PROCURADORIA GENERAL DE LA REPÚBLICA against civil defendant [Nombre 001] is dismissed in its entirety. Because there was a plausible basis for litigation, the civil actions for damages are resolved without a specific award of costs, and each party shall bear the attorney fees and procedural costs it incurred. Any precautionary measure (medida cautelar) against the accused and civil defendant shall cease. The property is NOT restored to its original condition, since ownership of possession of the real property must be adjudicated in another jurisdiction, by virtue of what was decided in this ruling. This judgment is issued by MSc. Juan Carlos Jiménez Marín, Trial Judge. NOTICE SHALL BE GIVEN BY READING.” (sic)
III.Following the corresponding deliberation in accordance with Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeals.
Drafted by Criminal Judgment Appeals Court Judge Valenciano Chinchilla; and, FINDINGS (CONSIDERANDO):
I.By a pleading appearing at pages 212 through 219 and received on 02 de mayo de 2024, Yorleny Ching Cubero, in her capacity as a prosecutor with the Public Prosecutor’s Office, filed an appeal against written judgment Nº296-2024 of the Criminal Court of the Second Judicial Circuit of the Atlantic Zone, issued at 11:40 hours on 8 de abril del 2024, by which the defendant was acquitted of the offenses of invasion of a protected wildlife area and usurpation of public-domain property; the private criminal complaint and civil action for damages filed were dismissed in their entirety, without a specific award of costs because there was a plausible basis for litigation; and restoration of the property to its prior condition was also denied. Andrés Alfaro Ramírez, in his capacity as Criminal State Attorney, likewise appealed the judgment through the appeal appearing at pages 221 through 233 of the main case file, submitted on 6 de mayo de 2024.
In this case, full compliance with the requirements for objective and subjective appealability (impugnabilidad objetiva y subjetiva) has been verified, and it is also evident that both appeals were duly filed within the prescribed time and in the proper form; accordingly, the appeals are admitted, and the Court proceeds to consider the alleged errors (agravios). Wilberth Picado Portuguez, in his capacity as private defense counsel for the accused, responded to the appeals by a filing appearing at pages 239 through 240, requesting that the appeals be denied because the judgment is consistent with the law.
II.In order to resolve the claims logically, they are addressed in an order different from that proposed by the appellants. Appeal filed by attorney Yorleny Ching Cubero, in her capacity as prosecutor for the Ministerio Público. As her second ground, she alleges defective and insufficient analytical and intellectual reasoning (fundamentación analítica e intelectiva). The judge failed to assess the testimony of the witnesses heard at trial in developing his reasoning. Instead, he asserted that they had lied, without explaining the basis for that assertion or conclusion, raising the question of why he did not order that a certified transcript of the relevant records (testimonio de piezas) be issued for perjury (falso testimonio). The judge relied on false assessments and disregarded basic legal principles, specifically that, because the property belongs to the State, it is by nature not subject to acquisitive prescription (imprescriptible) and inalienable (inalienable), and that the only way to hold a right over it is through a concession (concesión), not through a transfer of title (traslado de dominio) or an assignment of a possessory right (cesión de un derecho de posesión).
The validity of a bill of sale (carta venta) as a legal instrument for transferring property or rights is not denied; however, where the State holds the bare ownership right (derecho estatal de la nuda propiedad), possession thereof is inalienable, and any right may be exercised only with legal authorization, such as a concession, which is not the case here. The judge found that the accused had not invaded the disputed land because he entered into possession and continued exercising it, disregarding the State-owned nature of the property, which cannot be held through mere private possession, an arbitrary position contrary to law. It is also contradictory that he granted him the “full capacity to hold possession by means of private possession,” while at the same time stating that such possession arose from an instrument transferring title that was insufficient to produce effects in the property registry, assigning it an unclear value by referring to “a quasi-title to real property” in the country’s rural areas, which is customarily transferred through notarized documents.
He dismissed the existence of environmental damage (daño ambiental) because there had been no invasion, despite finding it proven that the defendant still remains on the disputed land and even carries out agricultural activities there, and that structures exist within a State protection area (área de protección estatal), deemed a protected wildlife area (área silvestre protegida), either because a portion falls within Parque Nacional Tortuguero under the decree or, alternatively, because it lies within the protection-zone area (área de zona de protección). The environmental damage was dismissed because there had been no invasion and the land was used for agriculture, without observing the provisions of the Ley de Biodiversidad and its management categories (categorías de manejo), which in no way authorize agricultural use, and the judgment disregarded the SINAC report concerning the environmental damage.
The court concluded that not even the SINAC officials were certain of the true location of the land in question—whether it was within the protection-zone area or the national park—disregarding all the georeferenced location reports (informes de localización geo referencial), SINAC-ACTO-DASP-PNT-DE-013-2019, SINAC-ACTO-AL347-2019, SINAC-ACTO-DASP-PNBE-049, SINAC-ACTO-AL-364-2019 and SINAC-ACT-ROCUHREH-CERT-107, which precisely located the disputed land. It also relied on false premises, arriving at fallacies and illusory conclusions; had it afforded weight to the evidence, it could have reached a different decision, due in part to the omission of evidence (preterición de prueba), which was assessed independently and incompletely, as well as incorrectly. This ground is granted: As a preliminary matter and to facilitate a better understanding of the ruling, it is necessary to reproduce the factual basis (plataforma de hechos) alleged against the accused: “1- Without determining the exact date and time, but during the period from 17 de mayo del 2019 through 05 de diciembre de 2019, in Limón, Pococí, Colorado, Tortuguero, across from the Cerro Tortuguero landing, between the geographic coordinates N 1169555 - N 1169835 and E 551454 - E 551719, the accused, [Nombre 001], knowing that his conduct was unlawful, without holding title to the property and without a right of possession, invaded and occupied the protected wildlife area known as Parque Nacional Tortuguero, insofar as he continued living in a dwelling constructed of wood and zinc sheets, measuring 05 metros across the front and 08 metros in depth, for a total of 80 metros cuadrados, with a 09 metros cuadrados wooden structure intended for poultry production and a 20 metros cuadrados landing constructed of wood and zinc sheets; all without authorization from the Administración Forestal del Estado. 2- Through those actions, the accused, [Nombre 001], caused environmental damage at the site of the events because structures are not permitted there, ‘valued at the sum of 5,902,314.55’” (see reverse of page 49 of the main case file).
For its part, the Procuraduría General de la República alleged the following sequence of events: “FIRST: Without being able to determine the exact date and time, but during the period from 17 de mayo del 2019 through 05 de diciembre del 2019, in Limón, Pococí, Colorado, Tortuguero, across from the Cerro Tortuguero landing, between the geographic coordinates N1169555-N1169835 and E551454-E551719, the accused, [Nombre 001], knowing that he had no authorization whatsoever and that the lands located within Parque Nacional Tortuguero form part of the State’s natural heritage (patrimonio natural de Estado), carried out acts constituting invasion by maintaining, making usable, and inhabiting a dwelling constructed of wood and zinc sheets, measuring five meters across the front and eight meters in depth, for a total of eighty square meters, with a nine-square-meter wooden structure intended for poultry production and a twenty-square-meter landing constructed of wood and zinc sheets.
SECOND: The damage caused by the accused, [Nombre 001], harmed the ecosystem of Parque Nacional Tortuguero, because the area where the invasion occurred is Class VIII, meaning land suitable for the preservation of flora and fauna, genetic reserves, and scenic beauty; furthermore, the affected area is classified and designated as a RAMSAR wetland of international importance (humedal de importancia internacional RAMSAR), particularly as a habitat for aquatic bird species. It should also be emphasized that, because this is a protected wildlife area whose primary purpose is preserving wildlife and scenic beauty, an invasion entails a serious alteration of those elements, particularly the latter, because it has a negative visual impact on visitors who pay to observe nature as such, in addition to disrupting the natural balance, especially birdlife, which is the most severely affected. Likewise, a number of other factors that suffer environmental harm may be mentioned, such as irreversible changes to ecological microclimates; alteration of niches and habitats of aquatic flora and fauna species; loss of substrate for native species; loss of flora and fauna species of extremely high medicinal value; and disruption of the natural regulation of bodies of water.
Accordingly, the environmental damage has been assessed in the reasonable sum of C1.000.000,00 (un millón de colones).” (see pages 124 through 125 of the main case file). The trial court acquitted the accused, stating that the evidence prevented it from finding the prosecution’s theory proven to the required degree of certainty, for the following reasons: i) It was not proven that the property at issue in these proceedings belonged to the Parque Nacional Tortuguero area, as stated in the indictment; ii) The accused possessed an instrument transferring title (título traslativo de dominio), under which possession of the property had been transferred to him; iii) The defendant “without had authorization from the State forestry administration” [sic]; iv) No environmental damage had occurred because the property continued to be used for the activity for which the original possessor had transferred it to him; v) The accused was alleged to have given “the order for tractors to enter the aforementioned property for the purpose of moving the earth and thereby extending the property so that scrap and rubble waste could be placed at the rear thereof, an act that does not imply, encompass, or inherently entail the construction of the terraces, which is the objective act on the basis of which the accused’s conviction was later requested.
Indeed, the factual allegation (imputación fáctica) must set out the circumstances and be clear and precise, so that the accused knows it and can defend himself against it. This requires the act to be clearly described in the charge, rather than an attempt being made, unexpectedly and at the end of the trial, to supplement it with whatever facts the prosecutor wishes to add” (see reverse of page 205 of the main case file). With respect to the first issue, the location of the property in question, the trial court made the following statement, reproduced in full: “Thus, facts 1 and 2 were not proven by the Ministerio Público; it was not proven that the property at issue in these proceedings belonged to the Parque Nacional Tortuguero area, as stated in the indictment. The accused possessed an instrument transferring title, under which possession of the property had been transferred to him. The accused without had authorization from the State forestry administration.
No environmental damage occurred because the property continued to be used for the activity for which the original possessor transferred it to him. As a material fact charged but not proven in this judgment, the indictment refers to the invasion of a protected wildlife area known as Parque Nacional Tortuguero, an invasion that did not occur because the accused entered through possession and continued exercising possession, using the land for the purpose for which he acquired the property. When possession of the lands at issue here was transferred, that land with forms part of Parque Nacional Tortuguero, which, when created, did not include the accused’s property; indeed, based on the evidence presented, this court still does not know with certainty which of the expansions undergone by the park included the property possessed by the accused. That lack of precision prevents the court from determining the circumstances in which the invasion occurred, its perpetrators or those responsible for it, and when specifically it may have occurred, for purposes of guaranteeing the accused the requirement of congruence between the indictment and the judgment (correlación entre acusación y sentencia), that is, whether the invasion occurred from 17 de mayo through 5 de diciembre del 2019.
Likewise, it cannot be determined whether the accused himself carried out the alleged invasion or whether he continued exercising a third party’s possession. It could not be proven that the accused constructed the structures identified in the indictment. Those structures could very well have been built by third parties, by previous owners, or by some other specific person, but, most importantly, this prevents a determination of whether that construction occurred within the protection area. In that regard, a conviction for invading a national park cannot be based solely on the witnesses’ assertion that the national park exists there, particularly when they are unable to specify the approximate dates on which those invasions occurred or whether they occurred within the national park area. In this regard, it should be added that the aforementioned witnesses were plainly confused as to which area is protected by the criminal offense under investigation here, including confusion regarding the precise location of the land. The witness JORGE CEDEÑO CALDERÓN stated that the land is located within the national park itself.
It cannot be established who carried out the land-use change (cambio de uso del suelo); rather, it is stated that the land-use change had already occurred (see testimony of Witness Jorge Cedeño Calderón). The land possessed is not located in Parque Nacional Tortuguero but under another legal designation known as a conservation area (área de conservación), which prevents the court from finding the complaint filed credible, since the alleged invasion of land within a national park does not correspond to the actual location of the land at issue. There are serious doubts that the land is among those designated as a protected wild area (área silvestre protegida) pursuant to sections 58(a) and 61 of the Ley Forestal, as well as doubts regarding the credibility of the claim that the described logging actually occurred within the fifty-meter area established by Article 33 of the Ley Forestal. Because of this reasonable doubt concerning the alleged invasion of the protected area (área protegida), the universal principle of doubt and the procedural principle of in dubio pro reo require that the accused be acquitted.
The accused’s possession has been tolerated by the State for more than twenty years, since the accused formally took possession of the land in 1998; before that possession began, it was already possessed by the person who transferred his right to him, and therefore there has been no change in the condition of the land’s natural resources. The accused has continued to conduct agricultural activities on the property, just as they were conducted before 1998. Documentary evidence establishes that the accused’s property did not correspond to the lands donated to the State by Fundación Neotrópica to become part of Parque Nacional Tortuguero. The lands purchased by Fundación Neotrópica did not border the national park’s canals; other lands border the canal but were not part of Fundación Neotrópica’s donations. The accused, [Nombre 001], has not committed any invasion; on the contrary, he purchased the possessory interest (posesión) in a property and has continued to exercise possession as owner” (cf. reverse of page 203 through reverse of page 204 of the main case file, verbatim transcription).
The court’s reasoning is not only confusing but also contradictory regarding an essential and central issue for deciding the case: whether the land in dispute formed part of Parque Nacional Tortuguero or of a protection area (área de protección). Clarification of this issue is crucial in light of the prosecution’s theory. First, the judge ruled out that the land was located within that park, relying on the fact that the accused held an instrument transferring possession of the property; afterward, however, he contradicted himself by asserting that it did form part of the park—not since its creation, but as a result of one of its expansions—without establishing through which expansion it was incorporated. He then maintained that a conviction could not be based solely on witnesses’ assertion that “there is a national park there,” attributing confusion to those witnesses but failing to identify them.
This is even more inconsistent given that he subsequently stated that Jorge Cedeño Calderón had affirmed that the land was within the national park. The court’s decision lacks valid grounds that would permit its reasoning to be understood; it is confusing and contradictory to the point that its decision cannot be fully understood. In addition, the judgment reveals another deficiency in its reasoning arising from the omission of essential evidence, as it failed to assess the testimony of Jorge Cedeño Calderón, Víctor Hugo Montero Navarro, and Carlos Calvo Gutiérrez, all officials responsible for guarding and patrolling Parque Nacional Tortuguero. They were clear and emphatic that they not only knew the site but also clearly understood the extent of its boundaries, which enabled them to determine that the accused was living inside the park. Their accounts were not weighed, even though they explained at length how they reached that degree of certainty and stated that they used a series of geolocation instruments that provided such precise positioning that the margin of error was approximately three meters.
The judge failed to weigh their accounts and, if he did so, failed to explain whether he believed them and, if not, his reasons for discounting their evidentiary weight. This was essential to enable the parties to review whether his assessment complied with the rules of sound rational judgment (sana crítica racional) and the principle of derivation (principio de derivación). The same applies to the extensive documentary evidence admitted at trial, as he did not even mention the weight assigned to it. Specifically absent is any assessment of the reports of the Ministerio de Ambiente y Energía appearing at pages 1 through 6, 36 through 38, 45 through 46, and 39 through 44, even though those documents referred to the land’s location by geographic coordinates obtained through a perimeter survey of the area using the GPS Map tool, based on the global positioning instrument and CRTM05 coordinates.
A map of the affected area, which was situated within Parque Nacional Tortuguero, was even attached. The report further specified that, “after examining the cartographic sheets of the basic map of Costa Rica at a scale of 1:50:000 and the digital layer of the country’s Protected Wild Areas from the Proyecto Grúas II, in the Geographic Information System of the Programa de Patrimonio Natural del Estado in ACTo, based on the geographic coordinates in the Costa Rican crtm05 projection system; CR05 datum, WGS84 Ellipsoid, contained in the report to the Fiscalía de Pococí SINAC-ACT0-DASP-PNT-DE-013-2019 dated May 18, 2019, those 23 pairs of GPS points describe a location INSIDE PARQUE NACIONAL TORTUGUERO, marine sector, created pursuant to Decreto Ejecutivo N11235-A, dated 24/09/70; Ley Nº5680 dated 13/11/75; Decreto Ejecutivo Nº11148-A dated 15/02/80; Ley Nº6749 dated 27/12/82; Decreto Ejecutivo Nº24428-MIRENEM dated 26/07/95; and Decreto Ejecutivo Nº27223-MINAE dated 21/08/98, corresponding to an apparent land-use change” (cf. page 36 of the main case file).
Nor was it considered that the same report showed that the 23 coordinate points taken on the day the accused was located on the land were within Humedal Palustrino, classified as FID1465, a wooded swamp of yolillo palms and sangrillo and cativo trees, covering an area of more than two thousand hectares and itself forming part of Humedal Internacional RAMSAR, known as Caribe Noreste, a wetland of special international importance as waterfowl habitat. This item of evidence did not receive even the slightest analysis, although it was relevant to whether the alleged conduct satisfied the elements of the offense (tipicidad). If the court considered that the property was not within Parque Nacional Tortuguero, it should have explained that conclusion and provided reasons supporting its rejection of the geolocation conducted on site using technological instruments and its departure from that determination.
None of this was done; therefore, the party is correct in alleging an inadequate examination of the evidence. Determining whether the land formed part of a national park or a protection area was central to subsequently examining whether precarious possession (posesión en precario) and/or the accused’s transfer of an instrument conveying title (título traslativo de dominio) was possible in view of the nature of the property. The court did not even consider the distinction between public-domain property and private property, because if the property belongs to the State, it is public-domain property (bien demanial) that is inalienable, not subject to acquisitive prescription, and exempt from attachment, none of which was examined by the court below (a quo). This Chamber notes that another error occurred in the interpretation and understanding of the alleged factual basis, because [Nombre 001] was never accused of ordering tractors to enter the land to remove soil and deposit scrap metal and rubble.
Such conduct cannot be inferred from a careful reading of the two charging documents, neither of which attributed such an act to him. Thus, one of the reasons invoked to acquit the accused bears no direct relationship to the events under examination and is therefore an entirely illegitimate argument. It should also be noted that a reading of the fifth and sixth recitals (considerandos), entitled “Principle of Correlation Between the Charge and the Judgment” and “Legal Classification,” shows that although the accused in this case is mentioned at the outset, the reasons stated actually correspond to other events involving a person surnamed [Nombre 006], who was accused of having constructed terraces outside the protection area covered by the criminal offense, as well as a water-storage tank. This demonstrates a serious lack of care by the judge, who used portions of a judgment from another proceeding that bears no relationship whatsoever to the acts attributed to [Nombre 001], all of which directly affected the decision reached.
For all the foregoing reasons, it may be concluded that, following a comprehensive examination of the written judgment on appeal, that judgment lacks adequate grounds providing a reasoned explanation of the decision adopted, because the evidence was subjected to a deficient intellectual assessment. The appeal must therefore be granted, the judgment on appeal declared absolutely null and void in both its criminal and civil aspects, and the case remanded for a new trial before the same Court with a different panel, so that it may issue the ruling required by law.
III.As the first ground, she alleges an absence of analytical and intellectual reasoning. Although, during closing arguments, it was requested that, pursuant to Article 140 of the Code of Criminal Procedure (Código Procesal Penal), matters be restored to their previous condition, the court did not rule on the State’s right to recover its rights over the land, thereby breaching its duty to provide reasons, violating due process (debido proceso), and preventing the parties from critically reviewing the decision that denied the request. The defect warrants rendering the entire judgment ineffective and holding the trial anew, which she accordingly requests. Appeal filed by attorney Andrés Alfaro Ramírez, in his capacity as Criminal Prosecutor for the State (Procurador Penal). As the third ground, he alleges a failure to provide reasons for denying the order to restore matters to their previous condition through the removal of the structures erected on the land at issue, the transfer and/or relocation of the farm animals, the uprooting of crops and/or the natural regeneration of the site, as well as the removal of debris.
In the operative portion (por tanto), the court merely stated the following: “Matters are NOT restored to their original condition, because the title to possession of the real property must be litigated in another jurisdiction, by virtue of what was decided in -this ruling.” The foregoing clearly lacks reasoning, because it contains no substantive analysis beyond referring the parties to another judicial forum, which flagrantly violates Article 142 of the CPP. The ruling is also inconsistent with the analysis conducted regarding the acquittal and the dismissal of the civil action for damages (acción civil resarcitoria), because, on the one hand, it establishes a right in favor of the accused but, on the other, establishes the need to litigate title to the property at issue through another proceeding. As explained in the preceding grounds of appeal, the court proceeded from errors in its intellectual assessment of the evidence and incorrectly applied the legal provisions under consideration, which led it to issue an equally erroneous judgment.
He adds that the trial court evaded its duty to rule on restitution, which must be ordered sua sponte and objectively, regardless of whether or not a conviction was entered, citing ruling 2007-0964 of the former Tribunal de Casación Penal del II Circuito Judicial de San José, issued at 10:00 hours on August 30, 2007. The court disregarded the fact that, pursuant to Article 50 of the Constitución Política and Article 54 of the Ley de Biodiversidad: “When environmental damage exists in an ecosystem, the State may take measures to restore, recover, and rehabilitate it.” In this regard, the State seeks the fair and balanced use of natural resources in order also to guarantee their enjoyment by future generations, based on Constitutional Law (Derecho de la Constitución), as well as on the statutory provisions specifically governing interim protection (tutela cautelar) in environmental matters—for example, the protective and pro natura principles contained in the Ley de Biodiversidad—whose necessary and mandatory application has been repeatedly affirmed by the binding case law of the Sala Constitucional in ruling 1250-1999, issued at 11:24 hours on February 19, 1999, and also in ruling number 199-2014 of March 27, 2014, of the Tribunal de Apelación de Sentencia Penal de San Ramón.
Had the trial court duly analyzed and examined the request to restore matters to their previous condition, based on the judicial precedents summarized above and the legal grounds invoked, it would have ordered that measure on the stated terms, because it was made absolutely clear at trial that, irrespective of criminal and civil liability (which we believe could indeed exist), the unlawful occupation of land located within Parque Nacional Tortuguero was established; no private individual has any right permitting such occupation because that property, even before becoming part of that protected area, was State-owned public-domain property (bien estatal de dominio público) and was therefore inalienable and not subject to acquisition by prescription. He requests that this ground be granted and that both the judgment and the trial be annulled, with a new proceeding ordered. Because both claims concern the same objection, they are considered jointly and are granted: A comprehensive review of the judgment shows that, regarding the request to restore matters to their previous condition, the court ruled as follows in the dispositive portion: “Matters are NOT restored to their original condition, because the title to possession of the real property must be litigated in another jurisdiction, by virtue of what was decided in -this ruling.” (cf. front of page 210 of the main case file).
Both appellants are correct because, throughout the judgment, the court below (a quo) entirely omitted to set forth the grounds for denying that request, even though it was a central aspect of the case. Pursuant to Article 50 of the Constitución Política, Article 140 of the Code of Criminal Procedure, and Article 103 of the Criminal Code (Código Penal), the judgment was required to address the restoration of matters to the condition in which they stood before the event examined in these summary proceedings, which may even be ordered sua sponte. Indeed, even if the accused had been acquitted of the criminal charge, there would be no legal obstacle to considering and deciding matters concerning the material object of this case, which is clearly connected to the regulations established in the Ley Forestal. It is therefore necessary to determine the appropriate disposition of the real property, which, according to the indictment, may belong to the public domain (carácter demanial), so that the proper course may be determined concerning restoration of matters to the condition in which they stood before the event that gave rise to this case, which could entail the need to demolish the structures.
The court was required to justify its decision by providing the evidentiary and legal grounds that led it to deny the application. It is impossible to understand why the court referred the parties to another jurisdiction—which it did not identify—to litigate title to possession of the real property. That decision breaches the duty to provide reasons established in Article 142 of the Code of Criminal Procedure, which provides that judgments must contain clear and precise reasoning, setting forth the factual and legal reasoning on which the judge’s decision is based and indicating the weight assigned to the evidence; failure to satisfy this requirement renders the judgment ineffective. Based on the foregoing, given the public interest involved and the clear propriety of considering and deciding the restoration of matters to the condition in which they stood before the event charged by the Ministerio Público and the Procuraduría General de la República, the claim is granted, and the ruling is annulled with respect to that issue.
IV.As the third ground, the prosecutor alleges an erroneous application of substantive criminal law and defective analytical and intellectual reasoning. The prosecution charged invasion of a conservation area (invasión a área de conservación) under Article 58(b), in conjunction with Article 61, both of the Ley Forestal. The judge proceeded from a false premise: that the accused acquired land held under precarious tenure (terreno en precario) by means of an instrument transferring the prior possession, and that such possession was tolerated by the owner, Japdeva. The judge thus failed to apply the applicable provision and concluded that there was no invasion “nor does his mere presence at the location confer upon him the right of possession over the land held by the State,” a criterion that she respects but does not share. This conclusion disregards the fact that a private bill of sale cannot transfer possessory title to State-owned land, where only the lawful titleholder may grant rights and, if it did so, it would be by assignment. She requests that this ground be granted, the judgment annulled, and a retrial ordered. No ruling is issued. For reasons of procedural economy and given the manner in which the matter has been decided, no ruling is issued on this ground.
V.Appeal filed by attorney Andrés Alfaro Ramírez, in his capacity as Criminal Prosecutor (Procurador Penal). As his first ground, he alleges erroneous reasoning and a contradictory intellectual assessment of the evidence, contrary to the rules of sound rational judgment (sana crítica racional), logic, and common experience, resulting from a biased and incomplete examination of the prosecution testimony in relation to the statements of the defense witnesses and the documentary evidence. He contends that substantial weight was given to documents having no such probative value, without explaining why they were deemed so credible, and that the court asserted, without justification, that there was doubt regarding the location of the land where the events occurred—Parque Nacional Tortuguero—and regarding the defendant’s alleged right of possession (derecho de posesión), which lacked legal support.
The court found the conduct not to constitute an offense (hecho atípico), suggesting that the accused might hold a right of possession over the portion of land that he had occupied for several years within that park. This constitutes a serious error because there is no doubt that the land lies within a national park, and no right of possession can arise from a transfer made outside the legal system. To reach these erroneous conclusions, the trial court first discounted the credibility of witnesses Jorge Cedeño Calderón and Víctor Hugo Montero Navarro, who confidently stated that the defendant had been occupying land within the national park, living in a rustic wooden house with a zinc roof and conducting agricultural and livestock activities in the surrounding area, specifically cultivating various crops that had been present for several years. The site also contained a structure used to raise chickens and pigs, within an affected area of approximately two hectares.
Both witnesses stated that all these activities, including occupying dwellings, are prohibited within national parks. They dated the impacts to the months beginning in May 2019, although they specified that the construction and tree felling that enabled the agricultural and livestock activities had been taking place for several years. Like Carlos Calvo Gutiérrez, the witnesses agreed that the described structures and impacts were located within Parque Nacional Tortuguero, based on coordinates taken with GPS equipment—with a margin of error of 3 meters—which were in turn compared with the coordinates of that national park. There was therefore no doubt regarding the defendant’s presence and the conduct of his productive activities within a protected area (zona protegida). All three officials were also clear that the national park was created by law in 1970 and subsequently expanded by two other decrees in 1980 and in 1997.
The three witnesses, all SINAC officials, stated that Fundación Neotrópica played a key role in the park’s second expansion during the 1990s, acting as an intermediary and using funds donated to the government of Costa Rica to compensate the occupants and inhabitants for improvements—not to purchase the land—on properties that had been inventoried years earlier for incorporation into the park and had long been registered in the name of JAPDEVA. Notwithstanding the foregoing, the trial court discounted the testimony of the persons mentioned, questioning the fact that the first two—Cedeño Calderón and Montero Navarro—could not specify within which expansion of Parque Nacional Tortuguero the land occupied by the defendant was located. It was subsequently learned through witness Calvo Gutiérrez that the land in dispute lies within the lands incorporated into the National Park in 1995, an incorporation formalized in 1997 through the issuance of an executive decree published in 1998.
In his view, that matter has no significant bearing on whether the defendant committed an offense or on the resulting civil consequences, namely the existence of environmental damage (daño ambiental) caused merely by the presence of structures that prevent the regeneration of soil subjected to land-use change (cambio de uso de suelo), because it is a wetland (humedal) designated exclusively for conservation. This excludes the possibility of inhabiting the site, maintaining crops, and keeping farm animals, which could cause pollution from animal excreta deposited in the bodies of water surrounding the site. Nor did the court pay sufficient attention to official Carlos Calvo Gutiérrez, who addressed not only the assessment and quantification of the environmental damage resulting from the defendant’s unlawful actions, but also the history of the creation of Parque Nacional Tortuguero and its expansions in 1980 and 1997.
He clarified that the properties registered as belonging to JAPDEVA, including the land occupied by the defendant, were incorporated into the National Park in 1998 pursuant to the 1997 decree and that, despite being registered in that institution’s name, they form part of the State’s natural heritage (patrimonio natural del Estado). When shown a survey plan (plano de agrimensura) and a registered cadastral plan (plano catastrado) submitted by the defendant, witness Calvo Gutiérrez reaffirmed that the land was within the park, that it formed part of the lands registered in the name of JAPDEVA, and that those lands had been incorporated into the State’s natural heritage. This information was also confirmed by certification ACTO-AL-364-2019, SINAC ACTO-PROCUHREH-CERT-2017, issued by the Sinac Área de Conservación Tortuguero. The witness stated categorically that none of the plans entered into the case file (expediente)—the survey plan and the registered cadastral plan—granted any right whatsoever to any person, because a survey plan is nothing more than a drawing prepared by a surveying engineer and has no effect whatsoever under the legal system.
Regarding the plan that was registered with the cadastre, the official candidly stated that it bore an endorsement (visado) from MINAE and that this should not have occurred, as an error had clearly been made in granting that endorsement. Nevertheless, he clearly explained that the endorsement amounted to a form of approval for formalizing some type of subsequent procedure or application before a government entity, but that it conferred no right of possession or ownership (dominio) over the property, particularly because the land not only forms part of the national park but also remains registered in the name of JAPDEVA, with a notation identifying it as part of the State’s natural heritage. Consequently, private individuals may not erect structures or conduct activities such as those carried out by the defendant. The court attached particular importance to the testimony of defense witnesses [Nombre 007], [Nombre 008], and [Nombre 009], who, far from providing coherent and credible accounts, revealed through their statements an excessive desire to favor the defendant, providing imprecise information that was not objectively corroborated by any State institution or even by any of the documentary evidence admitted into the proceedings.
He cites an excerpt from the testimony of witness [Nombre 007], from which it appears that the defendant purchased his land, apparently from its previous occupant, in 1998 and continued living at the site. This is reflected in the private purchase-and-sale agreements (cartas privadas de compraventa) entered into the case file, which created no rights because the property had long been registered in the name of JAPDEVA and bore a notation designating it as part of the State’s natural heritage, making it part of the public domain (demanio público) and therefore excluded from commerce. For his part, witness [Nombre 008] testified that he knew the land in dispute had had owners since 1977, whose names he did not specify, despite living in Casaverde, an area belonging to Distrito de Cariari de Pococí that is a considerable distance from Tortuguero. He then confusingly asserted that he knew the defendant from that community (Casaverde), but that the defendant subsequently moved to Tortuguero in 1988.
During questioning by the Prosecutor’s Office, however, he was unable to explain why he placed the defendant in Tortuguero in that year. Although this point was not recorded in the judgment, it can be verified in the recording of the trial. He then stated that he had also lived in Tortuguero from 2001 to 2023. He also acknowledged that Fundación Neotrópica had been involved in negotiations in Tortuguero, although he said that it purchased land, which is untrue because, since the lands belonged to the State (JAPDEVA), they were not purchased; compensation was paid only for improvements, as the prosecution witnesses stated, further demonstrating his inaccuracies. The witness also said that the negotiations with Fundación Neotrópica took place in approximately 2012, something we know did not occur at that time but many years earlier, between 1990 and 1995, as this led to the second expansion of the national park, formalized by the 1997 decree published in 1998, as witness Carlos Calvo Gutiérrez stated.
He objects that the judgment does not include all the questions put to and statements made by witness [Nombre 008]. This witness was shown a document submitted by the defense that contained two different types of handwriting and bore a signature in his name. When shown that document, handwritten in pen, he acknowledged his signature and identification number but claimed that he had not read the document and had not prepared it. The document stated that the defendant had taken possession of the land at issue in the dispute in 1998—that is, 10 years after the time he had previously identified—without being able to explain that discrepancy. This demonstrates a significant lack of knowledge of the facts and circumstances about which he was testifying and, worse still, revealed both the inaccuracies he committed and false information clearly intended to favor the defendant, all of which almost entirely undermines his credibility.
He points out that, after completing his testimony, this witness returned to the stand to speak with the defendant and defense counsel, then came back and stated that he needed money for a taxi. The defendant appeared nervous, took a banknote from his wallet, and handed it to the witness, who accepted it. The witness’s testimony had been taken expeditiously because he purportedly had to report to work, yet when he was identified, he stated that he was unemployed. In his opinion, all these matters cast doubt on the truthfulness of the witness’s statements, which even contradict the documentary evidence submitted by the defense, both the informal interview recorded in the document discussed above and the private purchase-and-sale agreement for the property, which show that the defendant did not arrive at the disputed site in the 1980s, but rather beginning in 1998. He challenges the court’s conclusion that the defendant had an alleged right of possession based on its weighing of weak and ambiguous evidence, such as the testimony of [Nombre 009].
That witness was wholly imprecise regarding the timing of the events, even unsuccessfully attempting to relate them to the time when electrical service began to be provided in the area. She also recounted JAPDEVA’s collection of land rents and stated that it abandoned those lands because it ceased collecting those amounts, and that it also gave documents to the occupants or tenants, suggesting that each interested person could legalize his or her status.
Regarding the foregoing, she explains that there is no evidence whatsoever that JAPDEVA collected payments, leased those lands, much less issued documents to transfer title to them or to confer a right of possession (derecho de posesión) upon any person; therefore, there is no statutory source or basis for verifying or supporting this assertion. It should be noted that the aforementioned witness stated that Fundación Neotrópica was in the area years ago negotiating with the occupants; however, like the other defense witnesses, she erroneously stated that the intention was to pay for the land, which is absolutely false, because what that Foundation did was agree upon payments for the improvements that the occupants had made to the land, since no payment was warranted for land belonging to the State (JAPDEVA). She reiterates that the defendant’s property is part of Parque Nacional Tortuguero and is recorded in the property registry for the Province of Limón under real-property folio number 96658, interest 000, in the name of JAPDEVA, as property in the public domain (bien de dominio público).
By way of background, she states that Ley N° 9205 del 23 de diciembre de 2013 confirmed, on the one hand, that the property under real-property folio number 96658, interest 000, registered in the name of JAPDEVA, is property in the public domain; nevertheless, it sought to recognize the rights of persons occupying land located within that property, for which purpose the property was to be removed from the public domain (desafectada), so that each person who believed that he or she was entitled to obtain title to the property being occupied could complete the procedure in accordance with the scope of the Ley de Informaciones Posesorias. Notwithstanding the foregoing, the aforementioned provision was declared unconstitutional by the Sala Constitucional through voto N° 2375-2017 de las 10:40 15 de febrero de 2017. This completely disproves the alleged issuance of property titles by JAPDEVA and confirms that the lands encompassed within the aforementioned property—including the property occupied by the defendant—are inalienable and not subject to acquisition by prescription (imprescriptible) public-domain property and are also included within the State’s forest estate (patrimonio forestal del Estado), pursuant to section 13 of the Ley Forestal, which prohibits changing the land use of the properties.
She emphasizes that, based on the prosecution’s testimonial evidence and the SINAC reports SINAC-ACTO-DASP-PNT-DE-013-2019, as well as supplemental reports numbers SINAC-ACTO-AL-347-2019, SINAC-ACTO-DASP-PNE-049, SINAC-ACTO-AL-377-2019, the land occupied by the defendant is subject to an additional land-use restriction because it belongs to a wetland area (zona de humedal) designated exclusively for conservation by law and by international agreements under RAMSAR, which entirely excludes agricultural and livestock activities. For all the foregoing reasons, she believes that the court’s decision lacks adequate reasoning, as it is based on a biased assessment of the evidence and disregards the fact that Zona Protectora Tortuguero is located near the land occupied by the defendant. Although that protected area is a classification distinct from a National Park and allows other activities and land uses, it is not the site where the land at issue is located; therefore, any discussion in that regard is irrelevant because it bears no relation to these proceedings.
This erroneous inference was one of the arguments used by the court to state that there was doubt regarding whether the site was located within the national park. That conclusion is mistaken because the SINAC reports and the maps attached thereto, together with the witness testimony given at trial, establish that SINAC officials took coordinates using GPS equipment to locate the land at issue and compared them against information systems, including SNIT (Sistema Nacional de Información Territorial), as well as maps and cartographic sheets. The results showed that the entire property occupied by the accused is within Parque Nacional Tortuguero, and there is no evidence capable of creating uncertainty in that regard. Another argument used by the trial court to support a state of doubt in favor of the accused, enter a judgment of acquittal, and dismiss the civil action for damages (acción civil resarcitoria) was the alleged violation of the principle of congruence between the charges and the judgment (principio de correlación entre acusación y sentencia).
The court stated that, according to the testimony and documentary evidence, the land-use change (cambio de uso del suelo) activities and the construction work dated back many years, whereas the timeframe alleged in the criminal and civil claims placed the activities attributed to the defendant between 17 de mayo al 05 de diciembre del año 2019, which precluded establishing the offense of invasion of Parque Nacional Tortuguero. Although it is true that it was not possible to prove that the defendant built the structures located on the land he occupies or that he initiated the land-use change caused by removing vegetation to establish crops and raise farm animals, since this has been occurring for years, there is no doubt that, on the dates in question and at present, the accused has remained at the site, residing in the structure used as a dwelling, maintaining it, and carrying out productive activities, animal husbandry, and agriculture on land located entirely within Parque Nacional Tortuguero.
This unquestionably constitutes the unlawful invasion of a conservation area, as governed by section 58(a) of the Ley Forestal. She emphasizes that the defendant was charged not only with constructing the buildings but also with engaging in all the acts of possession (actos posesorios) that he has continued to perform at the site, including residing there and carrying out agricultural and livestock activities; in other words, he has held and occupied land located within Parque Nacional Tortuguero that, by its nature, does not permit such use or continued presence. It is therefore evident that the charges brought by the Ministerio Público and the Procuraduría did not in any way violate the principle of congruence between the charges and the judgment, as the sentencing court mistakenly stated. The third factor invoked by the court in an attempt to support the judgment acquitting the accused was its finding that the defendant could not have invaded Parque Nacional Tortuguero because he exercised a right of possession over the land at issue, which he acquired through a sale and purchase transaction with the previous owner.
The court’s reasoning cannot be accepted because, as previously stated, the land at issue belongs to Parque Nacional Tortuguero and is located within a property registered in the name of JAPDEVA. It constitutes public-domain property that is not subject to acquisition by prescription, is inalienable, and is excluded from private commerce; it therefore cannot be privately appropriated. Accordingly, no act of possession could be legitimized, even if carried out for more than 10 or more; on the contrary, it constitutes continued unlawful occupancy of a property designated for conservation and forming part of Parque Nacional Tortuguero. Because it is public property (bien demanial), it could never give rise to a right of possession or title in anyone’s favor. She considers it incomprehensible that the existence of a right of possession in favor of the accused was taken as established, because there is no evidence whatsoever proving it, particularly since the evidence gathered as a whole establishes beyond any doubt the defendant’s unlawful presence within Parque Nacional Tortuguero, where he has caused environmental damage through agricultural and livestock activities.
If the defendant believes that he has a right of possession, or even that he is the lawful owner of the land, he must bring whatever legal actions he deems appropriate before the relevant judicial bodies, whether the agrarian courts or the administrative litigation jurisdiction (jurisdicción contenciosa administrativa). To date, however, this has not occurred—at least there is no evidence of it—and therefore the existence of a preliminary issue requiring prior adjudication (prejudicialidad) could not be considered either. In her view, there is consequently no circumstance preventing the defendant’s presumption of innocence from being rebutted so as to establish his guilt for the offense charged, or preventing the civil action for damages brought by this Procuraduría from being granted to obtain compensation for the environmental damage resulting from the unlawful acts committed by the accused.
In view of the foregoing, she requests that this appellate claim be granted as to this ground, that the challenged judgment be declared invalid because of the demonstrated defect, and that the matter be remanded to the Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, sede Pococí, so that, with a newly constituted panel and in a new trial, it may reconsider the matter in its entirety and issue a new, reasoned judgment consistent with the rules of sound rational judgment (sana critica racional), logic, and common experience, and with sections 142 and 184 of the same body of law. As her second ground, she alleges the erroneous application of sections 13 and 58(a) of the Ley Forestal, in conjunction with section 16 of the Ley de creación del Parque Nacional Tortuguero and the second transitory provision of that law. The court disregarded the concept of the State’s natural heritage (patrimonio natural del Estado), which includes, among other property, forest lands registered in the name of the State, autonomous institutions, and municipalities.
In this case, the land that the defendant has been occupying has been located within Parque Nacional Tortuguero since the year 1998 (second expansion), but within the property registered in the name of JAPDEVA. Consequently, that property forms part of the State’s natural heritage and is not susceptible to private appropriation. In finding that the accused had acquired a right of possession or even title to the property, the court disregarded the fact that this was legally impossible, because public-domain property does not lose that status through the passage of time or through mere tolerance of its occupation by private persons, nor does such occupation alter or diminish the designation and use of that property, which will always remain for public use unless removed from the public domain, which has not occurred in this case. Likewise, the court found that the defendant might have perfected a right of possession by virtue of JADEVA’s issuance of property titles relating to properties encompassed within the property registered in its name under real-property folio number 96658, interest 000, in the name of JAPDEVA, which were not part of Parque Nacional Tortuguero in 1975, and that this included the lands occupied by the defendant.
It must be acknowledged that, pursuant to the Ley de Creación del Parque Nacional Tortuguero N° 5680 del 3 de noviembre de 1975), section 16 granted JAPDEVA the authority to regulate land use and the exploitation of all natural resources within the lands that, in that year 1975, did not form part of Parque Nacional Tortuguero. It did so, however, only provided that the requirements of Transitory Provision II of that law were met, which states, insofar as relevant: “Transitory Provision II.—JAPDEVA, after consultation with ITCO, shall, within one year, proceed to deliver property titles duly recorded in the Registro Público to all occupants of rural properties in the communities located within the area delimited in Article 16—except those within the boundaries of Parque Nacional de Tortuguero—who satisfy the requirements established by the Ley de Informaciones Posesorias (...)”.
Under that provision, JAPDEVA was required to make the corresponding registrations in the names of all those who, following consultation with ITCO, subsequently known as IDA and currently as INDER (Instituto de Desarrollo Social), complied with the requirements of the Ley de Informaciones Posesorias; a period of one year was established for that purpose. However, this never occurred. In any event, it argues that JAPDEVA’s obligation to issue titles required two prior conditions: first, approval from ITCO (now INDER), and second, completion of a possessory-information proceeding (trámite de información posesoria) in compliance with the requirements established in that legislation, something that depended on the interested party and which, to date, there is no evidence was done. The litigant has not demonstrated the creation of any right in his favor, since he has not submitted any documentation from JAPDEVA referring to the granting or recognition of any right or authority over any land.
Nor has he submitted any evidence establishing that the persons who apparently occupied the property at issue (fundo objeto de la litis) before him—[Nombre 011] and [Nombre 012]—complied with the foregoing; consequently, no possessory or ownership right derived from them may be recognized in favor of the accused. The only evidence is a vague reference made at trial by a witness, which, moreover, is wholly unsupported. Neither evidence nor proof was presented to establish that alleged possessory right over the property at issue. Nevertheless, the trial court deemed it proven as grounds for the acquittal and even denied restoration of the property to its prior condition because ownership of the real property must be litigated in another judicial forum, which entirely contradicts the reasons given for absolving the accused of criminal liability and dismissing the civil damages action (acción civil resarcitoria).
Likewise, through a strained and erroneous application of section 58(a), the sentencing court held that the law has governed since the 1990s (since 1996) and that, even assuming there had been an encroachment upon Parque Nacional Tortuguero (as indeed occurred), no offense could have been committed because the defendant derived his possession from that begun by [Nombre 011] in the 1980s, purportedly beginning in 1987, and thereafter continued by [Nombre 012] until the transfer of the land. In its view, this conclusion is entirely mistaken because only Doña Letvia apparently occupied the property at issue when the criminal offense of encroachment upon Parque Nacional Tortuguero did not exist, unlike [Nombre 012] and the accused, who remained and have continued to remain at the site since the Ley Forestal took effect, without any justification. In any event, it considers the court’s reasoning on this issue misguided because, first, private parties cannot acquire rights in rem (derechos reales) over public-domain real property (inmueble de carácter demanial) and, second, this case does not concern the adjudication of the actions attributed to [Nombre 011] and [Nombre 012], but solely those of the defendant.
Had the judge assessed all the evidence received at trial as a whole and correctly applied and interpreted the applicable law, the judge would have found the offense of encroachment upon Parque Nacional Tortuguero proven and, consequently, would have granted the civil damages action brought by the State. The judgment infringes the right to effective judicial protection (tutela judicial efectiva) by fostering impunity, as well as section 50 of the Constitución Política, which guarantees all inhabitants the right to a healthy and ecologically balanced environment. That right was left unprotected by authorizing activities that undermine the purposes of Parque Nacional Tortuguero, including agricultural and livestock activities that are polluting and incompatible with the existence of that national park. It requests that the ground for appeal be upheld, that the challenged judgment be declared ineffective, and that the case be remanded for new proceedings. No ruling is issued. For reasons of procedural economy (economía procesal), and given the manner in which the matter has been resolved, no ruling is issued on the appellant’s other grounds.
THEREFORE:
The first and second grounds of the appeal filed by Ms. Yorleny Ching Cubero, in her capacity as prosecutor for the Public Prosecutor’s Office, as well as the third ground of the appeal filed by Mr. Andrés Alfaro Ramírez, in his capacity as Criminal State Attorney, are hereby upheld. Consequently, the challenged judgment is vacated in its entirety, and a retrial is ordered before the same Court, composed of different judges, so that it may hold an oral and public trial and issue the appropriate ruling in accordance with the law. Resolución: 2025-0348 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las ocho horas del veintiocho de febrero de dos mil veinticinco.
RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra [Nombre 001] quien es mayor de edad, costarricense, con cédula número [Valor 001], nacido en Limón, el 20 de octubre de 1954, hijo de [Nombre 002] e [Nombre 003], actualmente vecino de Limón Pococí; por el delito de INVASIÓN A UN ÁREA DE CONSERVACIÓN en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, la jueza Alejandra Valenciano Chinchilla, los jueces Giovanni Mena Artavia y Edwin Esteban Jiménez González. Se apersonaron en esta sede la Msc Yorleny Ching Cubero en representación del Ministerio Público, licenciado Andrés Alfaro Ramírez Procurador Penal y Wilberth Picado Portuguéz defensor particular del imputado.
RESULTANDO:
I.Que mediante sentencia número 296-2024 de las once horas cuarenta minutos del dieciséis de abril de dos mil veinticuatro, el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, resolvió: "POR TANTO: De conformidad con lo expuesto y artículos 8.2 de la Convención Americana de los Derechos Humanos, 39 y 41 de la Constitución Política, 1, 9, 142, 184, 360, 361, 363 a 366 del Código Procesal Penal; 1, 30, 31, 45, 227 inciso a) del Código Penal, artículos 58 inciso a) y 61 inciso c), así como el artículo 1045 del Código Civil. resuelve: Por mayoría en aplicación al Principio Universal de In Dubio Pro Reo, se ABSUELVE de toda pena y responsabilidad a los acusados [Nombre 001] por un DELITO DE INVASIÓN DE PAREA SILVESTRE PROTEGIDA EN CONCURSO IDEAL CON UN DELITO DE USURPACIÓN DE BIENES DE DOMINIO PÚBLICO que se le ha venido atribuyendo como cometido en perjuicio de los recursos naturales.
Son las costas del proceso penal a cargo del Estado. Se declara sin lugar en todos sus extremos la acción civil resarcitoria formulada por LA PROCURADORIA GENERAL DE LA REPÚBLICA, en contra del demandado civil [Nombre 001]. Se declara sin lugar en todos sus extremos la querella formulada por LA PROCURADORIA GENERAL DE LA REPÚBLICA, en contra del demandado civil [Nombre 001]. Por haber existido una razón plausible para litigar, se resuelven las acciones civiles resarcitorias sin particular condenatoria en costas, debiendo asumir cada parte las costas personales, así como procesales en que hubiera incurrido. Cese cualquier medida cautelar en contra del imputado y demandado civil. NO se restablecen las cosas a su origen, ya que corresponde en otra jurisdicción discutir la titularidad de la posesión del bien inmueble, en virtud de la resuelto en -la presente resolución. Emite esta sentencia MSc. Juan Carlos Jiménez Marín. Juez de juicio. POR LECTURA, NOTIFÍQUESE”. (sic)
II.Que, contra el anterior pronunciamiento, interpuso recurso de apelación la Msc Yorleny Ching Cubero en representación del Ministerio Público.
III.Que, verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el tribunal se planteó las cuestiones formuladas en los recursos de apelación.
Redacta la jueza de apelación de Sentencia Penal Valenciano Chinchilla; y,
CONSIDERANDO:
I.Mediante libelo visible a folios 212 al 219, recibido en fecha 02 de mayo de 2024, la licenciada Yorleny Ching Cubero, en su condición de fiscal del Ministerio Público interpuso recurso de apelación en contra de la sentencia escrita Nº296-2024, del Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, de las 11:40 horas, del 8 de abril del 2024, mediante la cual se absolvió al encartado del delito de invasión de área silvestre protegida y usurpación de bienes de dominio público, declarando sin lugar en todos sus extremos la querella y acción civil resarcitoria incoada, sin especial condenatoria en costas por haber existido razón plausible para litigar, rechazando además el restablecimiento de las cosas a su estado anterior. Asimismo, el licenciado Andrés Alfaro Ramírez, en su condición de Procurador Penal, también recurrió el fallo, mediante recurso visible a folios 221 al 233 del legajo principal, remitido el 6 de mayo de 2024.
En este caso, se ha verificado el cabal cumplimiento de los presupuestos de impugnabilidad objetiva y subjetiva, evidenciándose además que ambos recursos fueron debidamente presentados en tiempo y forma, en consideración a lo cual se admiten las impugnaciones y se procede a conocer sobre los agravios. El licenciado Wilberth Picado Portuguez, en su condición de defensor particular del acusado, dio respuesta a las impugnaciones, mediante escrito visible a folios 239 al 240, solicitando se declaren sin lugar los recursos, por estar la sentencia ajustada a derecho.
II.A fin de dar una solución a los reclamos de una forma lógica, se conocen en un orden distinto al propuesto por los recurrentes. Recurso de apelación de la licenciada Yorleny Ching Cubero, en su condición de fiscal del Ministerio Público. Como segundo motivo acusa el vicio de incorrecta e insuficiente fundamentación analítica e intelectiva. El juez omitió valorar las declaraciones de los testigos recibidos en juicio para darle contenido a sus razonamientos. Más bien afirmó que mintieron, sin explicar en qué fundó esa afirmación o conclusión, cuestionando por qué no ordenó un testimonio de piezas por falso testimonio. El juez partió de apreciaciones falsas, dejó de lado el conocimiento básico del derecho, en concreto que, al tratarse de bienes del Estado, por naturaleza son imprescriptibles, inalienables y el único modo de ostentar un derecho sobre ellos por medio de una concesión y no, por un traslado de dominio, por una cesión de un derecho de posesión.
No se niega el derecho a la carta venta como instrumento jurídico para el traspaso de bienes o derechos, pero, al tratarse de un derecho estatal de la nuda propiedad, su posesión es inalienable, pudiendo ejercer algún derecho solo por autorización legal, como una concesión que no es el caso. El juez consideró que el imputado no invadió el terreno en conflicto, porque lo hizo por posesión y continuó ejerciéndola, obviando la naturaleza estatal del bien, que no puede detentarse por simple posesión privada, posición arbitraria y contraria a derecho. También es contradictorio que, le dio la “totalidad de capacidades de detentar la posesión por medio de una posesión privada” pero, al mismo tiempo, refiera que aquella surge por un título traslativo de dominio que es insuficiente para crear efectos registrales, otorgándole un valor difuso al referir que es “un seudo dominio de los inmuebles” en las áreas rurales del país, que por costumbre se transmite por documentos notariales.
Desechó la existencia de un daño ambiental, porque no existió invasión, pese a tener por demostrado que el encartado aún permanece dentro del terreno en litis e incluso realiza labores agrícolas, hay edificaciones en un área de protección estatal, considerada área silvestre protegida, sea por porción a través del decreto del Parque Nacional Tortuguero o, en su defecto, por estar dentro del área de zona de protección. Se descartó el daño ambiental porque no hubo invasión y ser de uso agrícola, sin respetar lo establecido en la Ley de Biodiversidad y las categorías de manejo que, de forma alguna autoriza el uso agrícola, obviando en la sentencia el informe del Sinac sobre el daño ambiental. Concluyó que ni los propios funcionarios del Sinac tienen claro la verdadera ubicación del terreno en cuestión, si está dentro del área de zona de protección o de parque nacional, desconociendo todos los informes de localización geo referencial SINAC-ACTO-DASP-PNT-DE-013-2019, SINAC-ACTO-AL347-2019, SINAC-ACTO-DASP-PNBE-049, SINAC-ACTO-AL-364-2019 y SINAC-ACT-ROCUHREH-CERT-107 que localizó de forma exacta el terreno en litigio.
También partió de premisas falsas, arribando a falacias, y conclusiones ilusorias que, de haberle otorgado valor a la prueba, habría permitido arriba a una decisión distinta, en parte gracias a la preterición de prueba, que se valoró de forma independiente e incompleta, además de errónea. El motivo se declara con lugar: De previo y a efectos de una mejor comprensión de lo resuelto, resulta necesario transcribir la plataforma de hechos que se le atribuyeron al imputado: “1- Sin determinar la fecha y hora exacta, pero sí en el período comprendido del 17 de mayo del 2019 y hasta el 05 de diciembre de 2019, en Limón, Pococí, Colorado, Tortuguero, frente al embarcadero del Cerro Tortuguero, entre las coordenadas geográficas N 1169555 - N 1169835 y E 551454 - E 551719, el acusado [Nombre 001], a sabiendas de su actuar ilícito, sin contar con título de adquisición y sin derecho de posesión, invadió y detentó el espacio del área silvestre protegida denominada Parque Nacional Tortuguero, toda vez que se mantuvo viviendo en una casa de habitación, compuesta de madera y láminas de zinc de 05 metros de frente y 08 metros de fondo, para un total de 80 metros cuadrados, con una estructura compuesta de madera de 09 metros cuadrados destinada a la producción avícola y un embarcadero compuesto de madera y láminas de zinc de 20 metros cuadrados; todo sin contar con la autorización de la Administración Forestal del Estado. 2- Con dichas acciones, el acusado [Nombre 001], provocó un daño ambiental en el lugar de los hechos, por cuanto no se permiten edificaciones en el sitio, "valorado en la suma de 5,902,314.55" (cfr.49 vuelto del legajo principal).
Por su parte, la Procuraduría General de la República acusó la siguiente secuencia: “PRIMERO: Sin poder determinar fecha y hora exacta pero si en el período comprendido del 17 de mayo del 2019 y hasta el 05 de diciembre del 2019, en Limón, Pococí, Colorado, Tortuguero, frente al embarcadero del Cerro Tortuguero, entre las coordenadas geográficas N1169555-N1169835 y E551454-E551719 el endilgado [Nombre 001], a sabiendas que no tenía permiso alguno, y que los terrenos que se ubican dentro del Parque Nacional Tortuguero forma parte del patrimonio natural de Estado ha realizado actos propios de invasión al mantener, habilitar y habitar una vivienda construida en madera y láminas de zinc, con una medida de cinco metros de frente y ocho metros de fondo, para un total de ochenta metros cuadrados, con una estructura compuesta de madera de nueve metros cuadrados, destinada a la producción avícola y un embarcadero compuesto de madera y láminas de zinc con una medida de veinte metros cuadrados.
SEGUNDO: El daño efectuado por el imputado [Nombre 001], ocasionó un detrimento al ecosistema del Parque Nacional Tortuguero, ya que donde se lleva a cabo la invasión es de clase VIII, que significa tierras aptas para la preservación de flora y fauna, reserva genética y belleza escénica, asimismo el área afectada es catalogada y denominada humedal de importancia internacional RAMSAR, especialmente como hábitat de especies de aves acuáticas. Por otra parte, cabe resaltar que siendo esta un área silvestre protegida cuyo objeto primario es la preservación de la vida silvestre y belleza escénica, una invasión implica una fuerte alteración a estos elementos, particularmente el segundo ya que produce un impacto visual negativo al visitante que paga por la observación de la naturaleza como tal y además de la alteración al equilibrio natural sobre todo en la avifauna que es la más afectada. De igual manera se ponen mencionar otra serie de factores que sufren una afectación ambiental como lo sería el cambio irreversible en los microclimas ecológicos; alteración de nichos y hábitats de las especies de flora y fauna acuáticas, perdida de sustrato para las especies nativas, perdida de especies de flora y fauna con altísimo nivel medicinal y desequilibrio en el control natural de cuerpos acuáticos.
Por lo anterior se ha establecido la valoración del daño ambiental en la suma prudencial de C1.000.000,00 (un millón de colones).” (cfr. 124 al 125 del legajo principal). El tribunal absolvió al sindicado señalando que las pruebas impidieron concluir con el grado de certeza necesario la tesis acusatoria, bajo las siguientes razones: i) No se demostró que la propiedad de la presente litis perteneciera del área del Parque Nacional Tortuguero, tal y como se indicó en la acusación; ii) La persona imputada contaba con un título traslativo de dominio, donde se le transmitía la posesión de la propiedad; iii) El justiciable “sin contaba con la autorización de la administración forestal del estado” (sic); iv) No se ha realizado algún daño ambiental, puesto que el fundo siguió desarrollando la actividad por el cual el poseedor originario le trasladó; v) Al acriminado se le atribuyó haber dado “la orden para que tractores ingresaran a la citada propiedad cuyo fin era remover las tierras y así extender la propiedad para colocar los residuos de chatarras y escombros al final de esta, acción que no implica, comprende o lleva implícita la construcción de las terrazas que es la acción objetiva por la que solicitan luego la condena del acusado.
En efecto, la imputación fáctica debe ser circunstanciada, clara, precisa, de tal suerte que el acusado la conozca y pueda defenderse de ella. Ello conlleva que la acción esté claramente descrita en la imputación, y no que sorpresivamente se intente, al finalizar el juicio, complementaría con los hechos que el acusador desee darle” (cfr. 205 vuelto del legajo principal). Con respecto al primer aspecto, la ubicación del inmueble en cuestión, el tribunal hizo el siguiente señalamiento, que se transcribe in extenso: “Tenemos así que los hechos 1 y 2 no fueron demostrados por el Ministerio Público, no se demostró que la propiedad de la presente litis perteneciera del área del Parque Nacional Tortuguero, tal y como se indicó en la acusación. La persona imputada contaba con un título traslativo de dominio, donde se le transmitía la posesión de la propiedad. El imputado sin contaba con la autorización de la administración forestal del estado.
No se ha realizado ningún daño ambiental, puesto que el fundo siguió desarrollando la actividad por el cual el poseedor originario le traslado. Como hecho relevante acusado, y no comprobado en esta sentencia se habla de la invasión a una área silvestre protegida denominada Parque Nacional Tortuguero, invasión que no existió ya que el imputado ingreso por posesión y continuó ejercerciéndo la posesión, dando al suelo el uso por el cual adquirió el inmueble. Cuando se da la posesión de los terrenos aquí en litis dicho terreno con forma parte del parque nacional Tortuguero, el cual en su creación no contemplaba, el inmueble del imputado, incluso para este juzgado con las pruebas presentadas, hasta el momento no sabe a ciencia cierta a cual de las ampliaciones que sufrió el parque correspondió el inmueble que posee el acusado Esa imprecisión en que se incurre impide al tribunal concretar que la invasión ocurrió en circunstancias de autores o responsables de la misma, cuándo específicamente habría acontecido a efectos de garantizarle al imputado la garantía de correlación entre acusación y sentencia, es decir, si la invasión se dio del 17 de mayo al 5 de diciembre del 2019.
Así mismo no se puede determinar si fue el señor imputado el que realizó la acusada invasión o si el imputado continuó ejerciendo la posesión de un tercero. No se pudo demostrar que el imputado realizará la construcción de las edificaciones indicadas en la acusación. Perfectamente esas construcciones pudo ser realizada por terceros, o por anteriores propietarios, o por quién concretamente, pero esencialmente impide establecer si ella ocurrió dentro del área de protección. En ese sentido tenemos que una sentencia condenatoria por invasión a un Parque Nacional no puede sustentarse en la sola afirmación de los testigos de que allí existe el parque nacional, máxime si no logran circunstanciar en que fechas aproximadas se dieron esas invasiones, o si las mismas se dieron o no dentro del área del parque nacional. Es este sentido, vale agregar, resultó notoria la confusión existente en los mencionados testigos acerca de cuál es el área protegida por el tipo penal aquí investigado, confusión que en lo que respecta a donde está propiamente localizado el terreno, El testigo JORGE CEDEÑO CALDERÓN, afirmó que el terreno esta propiamente en el parque nacional.
No se puede establecer quien hizo el cambio de uso, sino que se indica que el cambio de uso ya estaba hecho (ver declaración del Testigo Jorge Cedeño Calderón) El terreno poseído no se ubica en el parque nacional tortuguero sino en otro figura jurídica denominada área de conservación, lo cual impide al tribunal concederle credibilidad a la denuncia interpuesta, ya que lo denunciado, de invasión a un terreno del un parque nacional no concuerda con la ubicación real del terreno en litis, se dan serias dudas de que el terreno sea de los cubiertos como área silvestre protegida de conformidad con el numeral 58 inciso a) y 61 de la Ley Forestal, pero además credibilidad en cuanto que la tala que describe ocurriera efectivamente dentro del área de los cincuenta metros que establece el artículo 33 de la Ley Forestal. Es por esta duda razonable en lo que interesa a esa invasión dentro del área protegida que corresponde, en atención al principio universal de duda, y procesal del indubio pro reo, absolver al imputado.
La posesión del imputado ha sido tolerada por el estado por más de veinte años, esto por cuanto el imputado formalmente tomó posesión de la misma desde el año 1998, de previo a dicha posesión ya existía otra posesión de la persona que le transmitió su derecho, por lo cual no existe variación en estado de los recursos naturales del terreno. El imputado ha continuado realizando actividades agrícolas en el fundo, tal y como se realizaba de previo a 1998. Se determina con prueba documental que la propiedad del imputado con correspondía con las tierras que la fundación Neotrópica donó al estado, para que formarán parte del Parque Nacional Tortuguero. Los terrenos que compró la fundación neotrópica no eran colindantes con los canales del parque nacional, existen otros terrenos que son colindantes con el canal, sin que los mismos formaran partes de las donaciones de la Fundación Neotrópica. El imputado [Nombre 001], no ha realizado invasión alguna, por el contrario el mismo compró la posesión de una propiedad, la cual ha seguido ejerciendo a posesión de dueño” (cfr. 203 vuelto al 204 vuelto del legajo principal, transcripción literal).
La motivación del tribunal no solo es confusa sino contradictoria en cuanto a un punto medular y esencial para la resolución del caso como lo es si, el terreno en discusión formaba parte o no del Parque Nacional Tortuguero o de un área de protección, resultando clave la dilucidación de este elemento, de cara a la tesis acusatoria. En primer orden el juez descartó que el terreno estuviera situado dentro de dicho parque, sustentándose en que el sindicado tenía un título traslativo de la posesión de la propiedad, pero después, y de forma contradictoria, aseveró que sí conforma parte de él, si bien no desde su creación, sí con alguna de las ampliaciones, sin establecerse en cuál de ellas se incorporó. De seguido sostuvo que la condenatoria no podía sustentarse en la sola afirmación de testigos de que “ahí es un parque nacional”, acusando una confusión en aquellos, de los que omitió puntualizar su identidad, lo que resulta aún más incongruente si, luego aseveró que Jorge Cedeño Calderón afirmó que el terreno estaba dentro del parque nacional.
La decisión del tribunal carece de fundamentos válidos que permitan comprender los alcances de sus razonamientos, resultando confusa y contradictoria, al punto que no se logra entender del todo su decisión. Además de lo anterior, el fallo evidencia otro defecto de fundamentación por preterición de prueba esencial, dejando de valorar no solo el dicho de los testigos Jorge Cedeño Calderón, Víctor Hugo Montero Navarro y Carlos Calvo Gutiérrez, todos funcionarios al cuido y patrullaje del Parque Nacional Tortuguero, quienes fueron claros y enfáticos en que no solo conocen el sitio, sino tienen claro cuáles son sus límites como extensión, lo que les permitió determinar que el sindicado estaba viviendo dentro del parque, sin que se ponderara sus versiones, pese a que fueron amplios en explicar cómo arribaron a tal seguridad y mencionaron que ellos usaron una serie de instrumentos de geolocalización que permitía una ubicación tan precisa que el margen de error era de unos tres metros, aproximadamente.
Omitió el juez ponderar sus versiones y si lo hizo, olvidó explicar si les creyó o no y, de haber sido así, las razones para restarles mérito, lo que resultaba esencial de cara a que las partes pudieran revisar si su ponderación se ajustó a las reglas de la sana crítica racional y al principio de derivación. La misma suerte corre la cuantiosa prueba documental evacuada en debate, de la que siquiera mencionó cuál fue el valor asignado a ella. En concreto se echa de menos la ponderación de los informes del Ministerio de Ambiente y Energía de folios 1 al 6, 36 al 38, 45 al 46, 39 al 44, pese a que, en tales documentos se hacía referencia a la ubicación del terreno por coordenadas geográficas, gracias al levantamiento perimetral del área con la herramienta GPS Map, de acuerdo con el instrumento de posicionamiento global, coordenadas CRTM05, adjuntándose incluso un mapa del área de afectación, que se situó dentro del Parque Nacional Tortuguero.
Incluso, se detalló que, “efectuado el estudio de las hojas cartográficas del mapa básico de Costa Rica, con escala 1:50:000 y en la capa digital de las Áreas Silvestres Protegidas del país del Proyecto Grúas II, en el Sistema de Información Geográfica del Programa de Patrimonio Natural del Estado en ACTo, con base en las coordenadas geográficas, en sistema de proyección para Costa Rica crtm05; datum CR05, Elipsoide WGS84 del informe a la Fiscalía de Pococí SINAC-ACT0-DASP-PNT-DE-013-2019 de fecha 18 de mayo de 2019, que dichos 23 pares de puntos de GPS describen una ubicación DENTRO DEL PARQUE NACIONAL TORTUGUERO, sector marino, creado según Decreto Ejecutivo N11235-A, del 24/09/70; la Ley Nº5680 del 13/11/75; Decreto Ejecutivo Nº11148-A del 15/02/80; Ley Nº6749 del 27/12/82; Decreto Ejecutivo Nº24428-MIRENEM del 26/07/95 y el Decreto Ejecutivo Nº27223-MINAE del 21/08/98, correspondiente a un aparente cambio de uso de suelo” (cfr. 36 del legajo principal).
Tampoco se ponderó que ese mismo informe daba cuenta que los 23 puntos de coordenadas tomadas el día en que se ubicó al sindicado en el terreno, se localizaban dentro del Humedal Palustrino, según catalogación FID1465, pantano arbolado de palmas de yolillo y árboles de sangrillo y cativo, con un área de más de dos mil hectáreas, a su vez parte del Humedal Internacional RAMSAR, denominado Caribe Noreste, humedal de especial importancia internacional como hábitat de aves acuáticas; elemento de prueba que siquiera fue objeto del más ligero análisis y era relevante de cara a la tipicidad de la conducta acusada. Si el tribunal consideró que el inmueble no estaba dentro del Parque Nacional Tortuguero así debió explicarlo y motivar cada una de las razones en la que se sustentaba para desvirtuar le geolocalización realizada en el sitio con instrumentos tecnológicos y apartarse de ese criterio, nada de lo cual se hizo, de ahí que, lleva razón la parte en cuanto alega un examen deficitario de los medios de prueba.
La determinación de si el terreno formaba parte de un parque nacional o de un área de protección era medular para de ahí, examinar si era posible una posesión en precario y/o una transmisión de título traslativo de dominio por parte del encartado, de cara a la naturaleza del bien, sin que el tribunal siquiera tomara en cuenta la diferencia de un bien de dominio público frente a uno privado, porque de ser estatal son bienes demaniales que son inalienables, imprescriptibles e inembargables, nada de lo cual fue objeto de estudio por el a quo. Denota esta cámara que se incurrió en otro error en cuanto al entendimiento y comprensión de la plataforma de hechos acusados, porque en ningún momento se le endilgó a [Nombre 001] haber dado orden de ingreso de tractores para remover tierra y colocar chatarra y escombros, acción que no se colige de la lectura cuidadosa de las dos piezas acusatorias que no le atribuyeron una acción como la señalada, denotándose así que una de las razones invocadas para absolver al sindicado no tiene relación directa con los sucesos bajo estudio, de ahí que es un argumento absolutamente ilegítimo.
Incluso debe mencionarse que, al dar lectura de los considerandos quinto y sexto, denominado “Principio de correlación entre Acusación y Sentencia” y “Adecuación Típica”, se desprende que, aunque al inicio se hace mención al aquí sindicado, en realidad, las razones que se apuntan corresponden a otros hechos, seguidos contra una persona de apellidos [Nombre 006], que se le acusaba por haber construido una terrazas, fuera del área de protección del tipo penal como de un tanque de captación de agua, denotándose así que medió una grave falta de atención del juez, que utilizó partes de una sentencia de otro proceso, que ninguna relación tiene con los hechos relacionados al endilgado [Nombre 001], todo lo cual ha incidido en forma directa en la decisión arribada. Es por todo lo antes expuesto que se puede concluir que, luego de efectuar un examen integral la sentencia escrita venida en alzada, aquella carece de fundamentos adecuados para explicar de forma motivada la decisión adoptada, al constatarse un deficiente análisis intelectivo de las pruebas, por lo cual se impone acoger el recurso y disponer la nulidad absoluta de la sentencia venida en alzada, tanto en lo penal como en lo civil, ordenando el juicio de reenvío ante el mismo Tribunal, con distinta integración para que resuelva lo que corresponda en derecho.
III.Como primer motivo alega inexistente fundamentación analítica e intelectiva. Pese a que, en etapa de conclusiones se solicitó que, de conformidad con el ordinal 140 del Código Procesal Penal se restituyera las cosas a su estado anterior, no se pronunció el tribunal en cuanto al derecho del Estado a ser restituido del derecho sobre las tierras, incumpliendo así con el deber de motivación, violentando el debido proceso e imposibilitando a las partes a la revisión crítica de la decisión que rechazó la petición. El vicio justifica la ineficacia total del fallo y la reposición del debate, lo que así solicita. Recurso de apelación del licenciado Andrés Alfaro Ramírez, en su condición de Procurador Penal. Como tercer motivo alega falta de fundamentación sobre el rechazo de la orden de restitución de las cosas a su estado anterior, a través del desalojo de las estructuras asentadas en el terreno objeto de la litis, el traslado y/o reubicación de los animales de granja, el desarraigo de cultivos y/o la regeneración natural del sitio, así como la limpieza de escombros.
El tribunal únicamente se limitó en el por tanto a decir lo siguiente: "NO se restablecen las cosas a su origen, ya que corresponde en otra jurisdicción discutir la titularidad de la posesión del bien inmueble, en virtud de la resuelto en -la presente resolución." Es notorio que lo anterior carece de fundamentación, pues no se hace ningún análisis de fondo, más allá de la remisión a las partes a otra sede judicial, lo cual violenta flagrantemente el numeral 142 del CPP. Lo resuelto es además contradictorio con en análisis efectuado con respecto a la absolutoria y rechazo de la acción civil resarcitoria, ya que por un lado establece un derecho a favor del imputado, pero luego, establece la necesidad de discutir la titularidad del bien objeto de la litis en otra vía. Como se hizo ver en los anteriores motivos de impugnación, el tribunal partió de errores en la valoración intelectiva de la prueba y aplicó erróneamente la normativa bajo estudio, lo cual lo condujo a emitir una sentencia igualmente errada.
Agrega que el tribunal de juicio eludió su deber de pronunciarse sobre la restitución, algo que debe darse de oficio y de manera objetiva, esto es al margen de se dictara o no una sentencia condenatoria, citando el voto del antiguo Tribunal de Casación Penal del II Circuito Judicial de San José, 2007-0964 de las 10:00 horas del 30 de agosto de 2007. Se obvió que, en apego al artículo 50 de la Constitución Política y 54 de la Ley de Biodiversidad: "Cuando exista daño ambiental en un ecosistema, el Estado podrá tomar medidas para restaurarlo, recuperarlo y rehabilitarlo." En ese entendido, lo que pretende el Estado es que se utilicen de manera justa y equilibrada los recursos naturales, a fin de garantizarle también a las futuras generaciones, el disfrute de ellos, con fundamento en el Derecho de la Constitución, así como en la preceptiva que a nivel legal especifica el tema de la tutela cautelar en materia ambiental, - verbigracia: los principios protector y pro natura, contenidos en la Ley de Biodiversidad- cuya necesaria e imperativa aplicación ha sido harto reiterado por la jurisprudencia vinculante de la Sala Constitucional, en el voto 1250-1999, de las 11:24 horas del 19 de febrero de 1999 y también en la resolución número 199-2014 del 27 de marzo del 2014, del Tribunal de Apelación de Sentencia Penal de San Ramón.
Si el Tribunal de juicio hubiese analizado y estudiado debidamente la petición de restitución de las cosas a su Estado anterior, tomando como base los antecedentes judiciales antes reseñados, así como los fundamentos legales invocados, hubiese dictado dicha medida en los términos referidos, ya que quedó absolutamente claro en el debate, independientemente de la responsabilidad penal y civil (que pensamos que sí podría existir), se acreditó la ocupación ilegítima de terreno que se encuentra dentro del Parque Nacional Tortuguero, sobre el cual no existe derecho alguno que así lo permita a favor de ningún particular, por cuanto ese fundo igualmente, antes de pasar a formar parte de dicha área protegida, es un bien estatal de dominio de dominio público, por tanto inalienable e imprescriptible. Solicita se declare con lugar el presente motivo y se anule el fallo, como el debate, ordenando una nueva sustanciación.
Por encontrarse ambos reclamos vinculados al mismo reproche, se conocen de forma conjunta y se declaran con lugar: De la revisión integral del fallo se desprende que, en cuanto a la solicitud de restitución de las cosas a su estado anterior, en la parte dispositiva, el tribunal resolvió lo siguiente: “NO se restablecen las cosas a su origen, ya que corresponde en otra jurisdicción discutir la titularidad de la posesión del bien inmueble, en virtud de la resuelto en -la presente resolución.” (cfr. 210 frente del legajo principal). Llevan razón ambos recurrentes porque a lo largo del fallo el a quo omitió desarrollar del todo el fundamento para descartar tal solicitud, a pesar de tratarse de un aspecto medular del caso, toda vez que de conformidad con lo estipulado en los artículos 50 de la Constitución Política, 140 del Código Procesal Penal y artículo 103 del Código Penal, debió resolverse en la sentencia lo referente al restablecimiento de las cosas al estado que tenían antes del hecho ventilado en esta sumaria, la que incluso puede ordenarse de oficio.
Véase que incluso, aún y cuando se hubiera absuelto penalmente al acusado, no existe obstáculo legal alguno para conocer y decidir en torno a lo relativo al objeto material de la presente causa, el que está claramente vinculado con la regulación dispuesta en la Ley Forestal, de ahí que sea necesario establecer lo correspondiente en cuanto al inmueble que, se según la acusación podría ser de carácter demanial, a efecto de que se defina lo procedente en torno a disponer el restablecimiento de las cosas al estado anterior del evento que determinó el surgimiento de la presente causa, lo que podría implicar la necesidad del derribo de las obras. El tribunal estaba obligado a justificar su decisión, brindando al efecto los fundamentos probatorios y jurídicos que le condujo a rechazar la gestión, sin que se logre comprender por qué ha remitido a las partes a otra jurisdicción, que no precisa cuál, a discutir la titularidad de la posesión de bien inmueble, decisión que quebranta los deberes de fundamentación, previsto en el ordinal 142 del Código Procesal Penal, el cual estipula que las sentencias deben contener una fundamentación clara y precisa, expresando los razonamientos de hecho y derecho, base de la decisión del juzgador, con indicación del valor otorgado a los medios de prueba; sancionando con ineficacia la omisión de dicho requisito.
Con base en lo expuesto y existiendo un interés público de por medio, resultando absolutamente procedente discutir y resolver lo atinente al restablecimiento de las cosas al estado que tenían antes del hecho acusado por el Ministerio Público y la Procuraduría General de la República, se acoge el reclamo planteado y se dispone la nulidad de lo resuelto en cuanto a ese extremo.
IV.Como tercer motivo alega la fiscal errónea aplicación de la ley penal sustantiva e incorrecta fundamentación analítica e intelectiva. La fiscalía acusó la invasión a área de conservación, conforme al ordinal 58 inciso b, en relación con el 61, ambos de la Ley Forestal. El juez partió de un hecho falso, que el imputado adquirió un terreno en precario, a raíz de un título traslativo de la posesión previa y que era tolerado por el titular Japdeva, dejando de aplicar así la norma para concluir que no hay invasión “ni se detenta con su sola presencia en el lugar el derecho de posesión que sobre el terreno ostenta el estado”, criterio que respeta, pero, no comparte. Al desconocer que una carta venta privada no puede trasladar el dominio de posesión de un terreno del Estado, donde solo el titular legítimo puede otorgar derechos y, de hacerlo, sería por cesión. Solicita se acoja el motivo y se anule el fallo, ordenando el juicio de reenvío. Se omite pronunciamiento. Por razones de economía procesal y dada la forma en que se ha resuelto, se omite pronunciamiento respecto a este motivo.
V.Recurso de apelación del licenciado Andrés Alfaro Ramírez, en su condición de Procurador Penal. Como primer motivo acusa fundamentación errónea y contradictoria valoración intelectiva de la prueba, que resulta contraria a las reglas de la sana crítica racional, la lógica y la experiencia común, gracias a un examen sesgado e incompleto de las declaraciones de cargo, respecto a las manifestaciones de los testigos de la defensa, así como de las probanzas documentales, confiriéndole gran valor a unos documentos que no lo tienen, sin brindar una explicación para otorgarles tanta credibilidad, aseverando una duda sobre la ubicación del terreno donde acaecieron los hechos, Parque Nacional Tortuguero, sin justificación al respecto, como del presunto derecho de posesión del imputado, sin soporte jurídico. El tribunal consideró el hecho atípico, dejando entrever que el sindicado podría tener un derecho de posesión sobre la porción del terreno que ha venido ocupando desde hace varios años, situado en dicho parque, lo que constituye un grave error, porque no cabe duda de que se ubica dentro de un parque nacional y no existe posibilidad de un derecho de posesión derivada de una transmisión al margen del ordenamiento jurídico.
Para llegar a estas erradas conclusiones, el tribunal de juicio primeramente, le restó credibilidad al dicho de los testigos Jorge Cedeño Calderón y Víctor Hugo Montero Navarro, quienes se mostraron seguros de que el imputado ha venido ocupando un terreno dentro del parque nacional, habitando en un casa de madera rústica con zinc y desarrollando actividad agropecuaria en el área aledaña, propiamente cultivos varios que datan de varios años, donde también existe una estructura dedicada a la cría de gallinas y cerdos en un área afectada de aproximadamente dos hectáreas. Ambos testigos indicaron que todas estas actividades, incluyendo la ocupación de viviendas, están prohibidas dentro de los parques nacionales, afectaciones que situaron a partir de los meses de mayo de 2019, aunque especificaron que las construcciones y tala de árboles que permitieron el desarrollo de actividades agropecuarias se venían desarrollando desde hace varios años.
Los testigos al igual que Carlos Calvo Gutiérrez, coincidieron en que las construcciones y afectaciones descritas se ubicaron dentro del Parque Nacional Tortuguero, con base en las coordenadas tomadas con equipos de GPS- con un margen de error de 3 metros-, que, a su vez fueron comparadas con las coordenadas de dicho parque nacional, por lo que no había ninguna duda en cuanto a la presencia del imputado y del desarrollo de sus actividades productivas dentro de una zona protegida. También fueron claros los tres funcionarios que dicho parque nacional fue creado por ley en 1970 y que posteriormente fue ampliado por otros dos decretos de 1980 y en 1997. Los tres testigos, todos funcionarios del SINAC, refirieron que, en la segunda ampliación del parque, en los años noventa, fue clave el papel de la Fundación Neotrópica, quien fungió como intermediario, utilizando fondos donados al gobierno de Costa Rica para pagar las mejoras no las tierras, a los ocupantes y habitantes de los terrenos que, desde años atrás fueron inventariados para incorporar al parque y que habían sido inscritos desde hace muchos años a nombre de JAPDEVA.
No obstante lo anterior, el tribunal de juicio le restó credibilidad al dicho de las personas en mención, al cuestionar que los dos primeros -Cedeño Calderón y Montero Navarro-, no pudieron precisar dentro de cuál de la ampliaciones del Parque Nacional Tortuguero se ubica el terreno ocupado por el imputado, aunque posteriormente se supo por medio del testigo Calvo Gutiérrez que, el terreno en discusión se ubica dentro de las tierras que fueron incorporadas al Parque Nacional en 1995 y se formalizaron en 1997, con la emisión de un decreto ejecutivo publicado en 1998, aspecto que, a su juicio no tiene mayor incidencia sobre la comisión de un delito por parte del imputado, ni sobre las consecuencias civiles derivadas del mismo, cual fue la existencia del daño ambiental por la sola presencia de construcciones que impiden la regeneración de un suelo sometido a cambio de uso de suelo, ya que el mismo corresponde a humedal, el cual está destinado solo a la conservación, lo cual excluye la posibilidad de habitar el sitio, darle mantenimiento a cultivos y mantener animales de granja, lo cual podría generar contaminación por las excretas de los animales que son depositados en los cuerpos de guas circundante al sitio.
Tampoco el tribunal prestó suficiente atención al funcionario Carlos Calvo Gutiérrez, quien se refirió no solamente a la valoración y cuantificación del daño ambiental derivado de las acciones ilícitas efectuadas por el imputado, sino también a los antecedentes de creación del Parque Nacional Tortuguero, a sus ampliaciones de 1980 y 1997, aclarando que los terrenos que le pertenecen registralmente a JAPDEVA, que incluyen el terreno ocupado por el imputado, fueron incorporados al Parque Nacional en 1998 por el decreto del año 1997 y que pese a encontrarse a nombre de dicha institución, forman parte del patrimonio natural del Estado. Al mostrársele un plano de agrimensura, así como un plano catastrado presentado por el imputado, el testigo Calvo Gutiérrez reafirmó que el terreno estaba dentro del parque, que era parte de las tierras inscritas a nombre de JAPDEVA y que fueron incorporados al patrimonio natural del Estado, información que también es ratificada por la certificación ACTO-AL-364-2019, SINAC ACTO-PROCUHREH-CERT-2017 emitida por el Sinac Área de Conservación Tortuguero.
El testigo afirmó contundentemente que, ninguno de los planos aportados al expediente (plano de agrimensura y plano catastrado), otorgan derecho alguno ni a ninguna persona, puesto que un plano de agrimensura no es más que un dibujo efectuado por un ingeniero topógrafo y que esto no tiene efecto alguno en el ordenamiento jurídico. Con respecto al plano que sí estaba catastrado, el funcionario fue sincero al decir que el mismo tiene un visado del MINAE y que ello no debió suceder, que evidentemente hubo un yerro al darse ese visado, sin embargo, fue claro al externar que ese visado es una especie de visto bueno para formalizar algún tipo de trámite o gestión posterior ante un ente gubernamental, pero, que eso no confiere ningún derecho de posesión o de dominio sobre el fundo, máxime que se trata de un terreno que no solo forma parte del parque nacional, sino que registralmente aparece todavía a nombre de JAPDEVA, que tiene la anotación de ser parte del patrimonio natural del Estado, lo cual no le permite a particulares hacer construcciones ni actividades como las que ha venido realizando el encartado.
El tribunal le confirió una especial relevancia a las declaraciones de los testigos de descargo [Nombre 007], [Nombre 008] y [Nombre 009], quienes lejos de brindar versiones coherentes y creíbles, más bien denotaron con sus afirmaciones, un afán desmedido por favorecer al imputado, dando información imprecisa y que no ha sido corroborada de manera objetiva por ninguna institución del Estado, ni siquiera por alguna de las pruebas documentales que fueron allegadas al proceso. Cita un extracto de la declaración de la testigo [Nombre 007], de la cual se rescata que el imputado compró su terreno, en apariencia, a su ocupante anterior en el año 1998 y que él siguió viviendo en el sitio, algo que se refleja en las cartas privadas de compraventa aportadas al expediente, lo que no genera derecho alguno, puesto que el bien está inscrito a nombre de JAPDEVA desde hace muchos años atrás, tienen una anotación de patrimonio natural del Estado, lo que lo convierte en parte del demanio público, excluido del comercio.
Por su parte en cuanto al testigo [Nombre 008] declaró conocer que el terreno en discusión tiene dueños desde 1977, cuyos nombres no precisó, pese a vivir en Casaverde, zona perteneciente al Distrito de Cariari de Pococí, que está considerablemente distante de Tortuguero, para de manera confusa aseverar que al imputado lo conoce de dicha comunidad (Casaverde), pero que él luego se fue a vivir a Tortuguero en 1988, sin que luego en el interrogatorio de la Fiscalía pudiera precisar por qué razón fijó esa presencia del imputado en Tortuguero para ese año, aspecto que no quedó consignado en la sentencia, pero puede ser corroborado en la grabación del debate. Luego indicó que él también vivió en Tortuguero desde el año 2001 al 2023, también reconoce que la Fundación Neotrópica estuvo en Tortuguero con las negociaciones, aunque dice que compró terrenos, algo que no es cierto, puesto que los terrenos al ser del Estado (JAPDEVA) no se compraron, solo se pagaron mejoras, tal y como lo dijeron los testigos de cargo, lo que denota aún más sus imprecisiones.
También el testigo dijo que la negociación con la Fundación Neotrópica tuvo lugar aproximadamente en el año 2012, algo que conocemos no sucedió en esa época, sino muchos años antes, entre los años 1990 a 1995, pues ello dio pie a la segunda ampliación del parque nacional, formalizado en el decreto del año 1997 publicado en 1998, tal y como lo afirmó el testigo Carlos Calvo Gutiérrez. Recrimina que el fallo no contempla todas las preguntas y afirmaciones efectuadas al testigo [Nombre 008], a éste se le mostró un documento presentado por la defensa, que presenta dos tipos de letras distintos y que tenía una firma a su nombre. Al mostrarle ese documento escrito a mano con lapicero, reconoció su firma y número de cédula, pero aseguró no haber leído el documento y que él no lo confeccionó. Dicho documento aseguraba que el imputado había llegado a poseer el terreno objeto de la litis en el año 1998, o sea, 10 años después del momento histórico que había afirmado antes, sin lograr explicar esa circunstancia, lo cual denota un importante desconocimiento de los hechos y circunstancias sobre las que estaba declarando y, lo que es peor, que hacía evidente imprecisiones en que incurrió así como información falsa, claramente para favorecer al imputado, razones todas que le restan credibilidad casi que por completo.
Hace ver que este testigo al finalizar su declaración regresó al estrado para hablar con el imputado y el defensor, luego se devolvió y afirmó que necesitaba dinero para el taxi, mostrando el imputado nerviosismo y sacó de su billetera un billete para entregarlo al testigo que lo aceptó, testigo que se recibió con premura porque tenía que entrar a trabajar, pero, al ser identificado, dijo ser desempleado. En su opinión, todos estos aspectos permiten dudar sobre la veracidad de las manifestaciones del testigo, las cuales incluso contradicen la prueba documental aportada por la defensa, tanto en la entrevista informal que quedó plasmada en el documento anteriormente comentado, como en la compraventa privada del fundo, donde se deriva que el imputado nunca llegó al sitio del litigio en los años ochenta, sino a partir de 1998. Cuestiona que el tribunal considerara que el imputado tenía un presunto derecho de posesión, a partir de la ponderación elementos de prueba débiles y anfibológicos, tales como la declaración de la señora [Nombre 009].
Dicha testigo presentó una total imprecisión de la ubicación temporal de los hechos, ya que incluso intentó referenciar los hechos al momento en que se comenzó a brindar el servicio eléctrico en la zona, sin éxito. Incluso narró acerca del cobro de alquileres de tierras por parte de Japdeva y que la misma dejó en abandono esos terrenos, pues dejo de cobrarles esos montos y que, también entregaba papeles a los ocupantes o arrendatarios, dejando entrever que cada persona interesada podría legalizar su situación. Sobre lo anterior, explica que no existe prueba alguna de que JAPDEVA hiciera cobros, arrendara esas tierras y mucho menos que entregara documentos para trasmitir la titularidad de estos o para derivar un derecho de posesión a favor de persona alguna, de ahí que no existe fuente normativa o fundamento para verificar o respaldar esta aseveración. Nótese que la testigo en mención indicó que Fundación Neotrópica estuvo hace años en la zona negociando con los ocupantes, sin embargo, de manera errónea al igual que los demás testigos de la defensa, indicó que se pretendía pagar terrenos, algo que es absolutamente falso, pues lo que se hizo esa Fundación fue acordar pagos con referencia a las mejoras que los ocupantes habían hecho sobre los terrenos, ya que no correspondía hacer pago alguno por terrenos pertenecientes al Estado (JAPDEVA).
Reitera que el fundo del imputado corresponde al Parque Nacional Tortuguero y registralmente se localiza en el partido de la Provincia de Limón, folio real número 96658, derecho 000 a nombre de JAPDEVA, bien de dominio público. Manifiesta como antecedente que, a través de la Ley N° 9205 del 23 de diciembre de 2013, ratificaba por un lado que la finca de folio real número 96658, derecho 000, inscrito a nombre de JAPDEVA, es un bien de dominio público, no obstante, se pretendía reconocer derechos a las personas que ocupaban terrenos ubicados dentro de dicha finca, para lo cual se desafectada el inmueble, a fin de que cada persona que estimara contaba con derecho a titular el fundo que venía ocupando, realizara el trámite de acuerdo con los alcances de la Ley de Informaciones Posesorias. No obstante, lo anterior, la referida norma fue declarada inconstitucional por la Sala Constitucional, mediante el voto N° 2375-2017 de las 10:40 15 de febrero de 2017.
Esto viene a desmentir por completo la entrega de títulos de propiedad por parte de JAPDEVA y ratifica que los terrenos inmersos en el inmueble ya citado -como lo es el fundo que ocupa el imputado- son bienes de dominio público de carácter inalienable e imprescriptible, que además se encuentran incluidos dentro del patrimonio forestal del Estado, de acuerdo con el numeral 13 de la Ley Forestal, que impide cambiar el uso de la tierra de los inmuebles. Resalta que gracias a la prueba testimonial de cargo y de los informes del SINAC SINAC-ACTO-DASP-PNT-DE-013-2019, además de las ampliaciones números SINAC-ACTO-AL-347-2019, SINAC-ACTO-DASP-PNE-049, SINAC-ACTO-AL-377-2019, el terreno ocupado por el imputado tiene una limitación de uso del suelo adicional, ya que pertenece a una zona de humedal, destinada por ley y convenios internacionales entre RAMSAR, a la conservación exclusivamente, lo que excluye por completo el desarrollo de actividades agropecuarias.
Es por todo lo expuesto que estima que la decisión del tribunal carece de una adecuada fundamentación, a partir de un estudio sesgado de la prueba, obviando que cerca del terreno ocupado por el imputado, se ubica la Zona Protectora Tortuguero, figura que si bien es una figura distinta de la Parque Nacional, permite el desarrollo de otras actividades y usos de la tierra, pero, no corresponde al sitio donde se asienta el terreno de la litis, por lo que cualquier reflexión al respecto está demás, al no tener relación con el proceso de marras. Esta errónea derivación, fue uno de los argumentos empleados por el tribunal para afirmar que había duda sobre la ubicación del lugar dentro del parque nacional, lo que es un desacierto ya que los informes del Sinac y los mapas anexos a dichos insumos, sumado a las declaraciones testimoniales rendidas en juicio, permiten concluir que los funcionarios del SINAC tomaron coordenadas con equipos GPS para localizar el terreno en discusión, que fueron comparados con sistemas de información entre ellos el SNIT (Sistema Nacional de Información Territorial) y mapas y hojas cartográficas, dando como resultado que la totalidad del fundo ocupado por el acriminado se encuentra dentro del Parque Nacional Tortuguero, sin que exista ningún elemento probatorio que resulte capaz de generar incertidumbre al respecto.
Otro de los argumentos del Tribunal de juicio para fundar el estado de duda favor del acriminado y dictar la sentencia absolutoria y declarar sin lugar la acción civil resarcitoria, es la presunta ruptura del principio de correlación entre acusación y sentencia, ya que se señala que, de acuerdo con los testimonios y la prueba documental, las actividades de cambio de uso del suelo, así como las construcciones eran de vieja data, mientras que el espacio temporal de los requerimientos acusatorios y civiles ubicaron las actividades atribuidas al imputado entre 17 de mayo al 05 de diciembre del año 2019, lo cual impedía configurar el delito de invasión al Parque Nacional Tortuguero. Si bien es cierto no resultó posible acreditar que el imputado haya edificado las estructuras asentadas en el terreno que ocupa y que, el cambio de uso de suelo por la eliminación de vegetación para establecer cultivos y criar animales de granja lo hubiera iniciado él, pues esto lleva años, no hay duda que, para las fechas referidas y en la actualidad, el acriminado ha permanecido en el sitio, habitando la edificación destinada a vivienda, dándole mantenimiento a la misma y desarrollando actividades productivas, cría de animales y agricultura en un terreno que se encuentra en su totalidad dentro del Parque Nacional Tortuguero, lo que sin duda configura la ilicitud de invasión un área de conservación, conforme lo regula el numeral 58 inciso a) de la Ley Forestal.
Enfatiza que al justiciable se le endilgó no solo la construcción de las edificaciones, sino además la realización de todos los actos posesorios que ha venido realizando en el sitio, vivienda y actividades agropecuarias, es decir, la detentación y ocupación de un terreno ubicado dentro del Parque Nacional Tortuguero, que por su naturaleza no permite dicho uso ni la permanencia en el lugar, de ahí que resulta evidente que con las imputaciones del Ministerio Público y de la Procuraduría, no se vulnera en modo alguno el principio de correlación entre acusación y sentencia, como equivocadamente lo externó el tribunal sentenciador. El tercer elemento que invocó el tribunal para intentar fundamentar la sentencia absolutoria a favor del encartado, lo fue la consideración de que el imputado no pudo haber invadido el Parque Nacional Tortuguero por haber ejercido el derecho de posesión del terreno en discusión, que adquirió a través de una compraventa efectuada con el anterior propietario.
Esta justificación del tribunal, no es de recibo por cuanto tal y como se dijo anteriormente, el terreno objeto de la litis pertenece al Parque Nacional Tortuguero y se encuentra dentro de una finca inscrita a nombre de JAPDEVA, constituye un bien de dominio público, imprescriptible e inalienable, excluido del comercio de los hombres, no pudiendo ser objeto de apropiación por parte de particulares, de ahí que no podría legitimarse ningún acto de posesión aunque se haya realizado por más de 10 o más, sino todo lo contrario, se configura una actividad de permanencia ilegítima en un inmueble destinado a la conservación y que forma parte del Parque Nacional Tortuguero, que al ser un bien demanial nunca podría generar derecho de posesión o titularidad a favor. Considera incomprensible que se tenga por sentado la existencia de un derecho de posesión a favor del acriminado, ya que no existe prueba alguna que lo demuestre, máxime que la prueba recabada en su conjunto permite establecer sin duda alguna la presencia ilegítima del imputado dentro del Parque Nacional Tortuguero, que, con el desarrollo de actividades agropecuarias, ha causado daños al ambiente.
Si el imputado estima que a su favor existe un derecho de posesión, o incluso que él es el legitimo propietario del terreno, debe entonces plantear la acciones legales que estime convenientes ante las instancias judiciales correspondientes, ya sean los tribunales agrarios o bien, la jurisdicción contenciosa administrativa, sin embargo, esto a la fecha no ha sucedido (al menos no existe evidencia al respecto), por lo que tampoco podría ponderarse la existencia de prejudicialidad, de ahí que no existe a su juicio situación que impida derribar el estado de inocencia del imputado, para establecer su culpabilidad por el delito que se le viene atribuyendo, así como declarar con lugar la acción civil resarcitoria incoado por ésta Procuraduría, para reclamar el resarcimiento por el daño ambiental derivado de las acciones ilícitas cometidas por el acriminado. En razón de lo expuesto, solicita se declare con lugar la presente gestión recursiva en lo tocante al presente motivo, se declare la ineficacia de la sentencia recurrida por la existencia del vicio evidenciado y se disponga el reenvío ante el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, sede Pococí, para que con una nueva integración y en otro debate, analice nuevamente el asunto en forma integral, emitiendo una nueva sentencia fundamentada acorde con las reglas de la sana critica racional, la lógica y la experiencia común y con los numerales 142 y 184 del mismo cuerpo legal.
Como segundo motivo alega errónea aplicación de los artículos 13 y 58 inciso a de la Ley Forestal, en correlación al 16 de la Ley de creación del Parque Nacional Tortuguero en el transitorio segundo de dicha ley. El tribunal pasa por alto el concepto de patrimonio natural del Estado, el cual conforman entre otros, los terrenos forestales inscritos a nombre del Estado, instituciones autónomas y municipalidades. En este caso, el terreno que ha venido ocupando el imputado se ubica dentro del Parque Nacional Tortuguero, a partir del año 1998 (segunda ampliación), pero dentro de la finca que registralmente se encuentra inscrita a nombre de JAPDEVA. En consecuencia, dicho inmueble integra parte del patrimonio natural del Estado, por lo que no es susceptible de apropiación privada. Al establecer el tribunal la adquisición de un derecho de posesión o incluso titularidad del fundo, por parte del acusado, lo hizo pasando por alto que no era legalmente posible, puesto que los bienes de dominio público no pierden ese carácter por el transcurso del tiempo o por la mera tolerancia de la ocupación por parte particulares, ni tampoco modifican o menoscaban el destino y uso de esos bienes, que siempre estarán para el uso público, a menos que sea desafectado, lo que no ha ocurrido en este caso.
De igual forma, determinó la posibilidad de que el imputado hubiera consolidado un derecho de posesión, en virtud del otorgamiento de títulos de propiedad por parte de JADEVA, con relación a fundos comprendidos dentro de la finca inscrita a su nombre, bajo el folio real número 96658, derecho 000 a nombre de JAPDEVA y que, para 1975 no formaran parte del Parque Nacional Tortuguero y que eso incluía los terrenos ocupados por el justiciable. Debe reconocerse que, de acuerdo con la Ley de Creación del Parque Nacional Tortuguero N° 5680 del 3 de noviembre de 1975), en el numeral 16 le confirió a JAPDEVA la posibilidad de regular el uso de la tierra y el aprovechamiento de todos los recursos naturales, dentro de los terrenos que, para ese año 1975 no conformaban parte del Parque Nacional Tortuguero, sin embargo, ello lo hizo siempre que se cumplieran los requisitos del transitorio II de dicha ley la cual dice en lo conducente: "Transitorio II.- JAPDEVA, previa consulta con el ITCO, en el término de un año procederá a entregar títulos de propiedad debidamente inscritos en el Registro Público a todos los ocupantes de fincas rurales de los pueblos que se encuentren en la zona delimitada en el artículo 16 -exceptuando a los que estén dentro de los límites del Parque Nacional de Tortuguero- que reúnan los requisitos que establece la Ley de Informaciones Posesorias (...)”.
De acuerdo con dicha norma, JAPDEVA debía hacer las respectivas inscripciones a nombre de todos aquellos que, previa consulta con el ITCO, posteriormente conocido como IDA y actualmente INDER (Instituto de Desarrollo Social) y cumplieran con las prescripciones de la Ley de Informaciones Posesorias, estableciendo un plazo de un año para tal efecto, sin embargo, esto nunca llegó a ocurrir. En todo caso, sostiene que la obligación de JAPDEVA de entregar títulos, requería dos situaciones previas, primero el visto bueno del ITCO (ahora INDER) y, por otra parte, la realización de un trámite de información posesoria cumpliendo los requisitos establecidos en dicha legislación, algo que dependía de la persona interesada y que a la fecha no consta que se haya hecho. El justiciable no ha demostrado la constitución de derecho alguno a su favor, ya que no ha presentado documentación alguna de JAPDEVA, que haga alusión al otorgamiento o reconocimiento de alguna facultad o atribución en ningún terreno, tampoco ha presentado prueba alguna que acredite que las personas que, en apariencia ocuparon el fundo objeto de la litis antes que él -[Nombre 011] y [Nombre 012]- hayan cumplido con lo anterior, de manera que no es posible derivar derecho de posesión o de propiedad que de ellos derive a favor del acriminado.
Lo único que existe es una vaga referencia hecha en juicio por una testigo, la cual por cierto no tiene respaldo alguno. No se demostró ni se aportó prueba para establecer ese supuesto derecho de posesión del fundo objeto de la litis, pese a lo cual, el tribunal de juicio sí lo tuvo por demostrado para fundar la absolutoria e incluso, rechazó la restitución de las cosas a su estado anterior porque la titularidad del inmueble debe discutirse en otra sede judicial, lo cual contradice totalmente las razones dadas para exonerar penalmente y declarar sin lugar la acción civil resarcitoria. Igualmente, el tribunal sentenciador, haciendo una aplicación forzada y errada del numeral 58 inciso a), sostuvo que dicha ley rige a partir de los años 90 (a partir de 1996) y que, aún asumiendo que hubo invasión al Parque Nacional Tortuguero (como en efecto ocurrió), no podría haber delito, ya que el imputado derivó la posesión que había iniciado [Nombre 011] desde los años ochenta, supuestamente a partir de 1987 y luego [Nombre 012] hasta el traspaso de las tierras.
Esta conclusión a su juicio es completamente desacertada, ya que solamente doña Letvia en apariencia ocupó el terreno objeto de la litis, cuando no existía la figura delictiva de invasión al Parque Nacional Tortuguero, caso distinto a los señores [Nombre 012] y el acriminado, quienes permanecieron y han permanecido en el sitio a partir de la vigencia de la Ley Forestal, sin ninguna justificación. En todo caso, estima que la reflexión hecha sobre el particular por el tribunal resulta desafortunada porque la constitución de derechos reales a favor de particulares sobre un inmueble de carácter demanial no procede y, en segundo término, porque no se está juzgando en este caso las acciones atribuidas a los señores [Nombre 011] y [Nombre 012], sino solamente del imputado. Si el juez hubiera valorado integralmente las probanzas recibidas en juicio y aplicado e interpretado de manera correcta la normativa habría tenido por demostrado el delito de invasión al Parque Nacional Tortuguero y consecuentemente, hubiese acogido la acción civil resarcitoria incoada por el Estado.
El fallo lesiona la tutela judicial efectiva al generar impunidad, así como el numeral 50 de la Constitución Política que garantiza un derecho a un ambiente sano y ecológicamente equilibrado de todos los habitantes, el cual quedó desprotegido al autorizar actividades que lesionan los fines del Parque Nacional Tortuguero, al autorizar el ejercicio de actividades agropecuarias que son contaminantes e incompatibles con la existencia de dicho parque nacional. Solicita se declare con lugar el motivo y se declare la ineficacia de la sentencia recurrida, disponiendo el reenvío para una nueva sustanciación. Se omite pronunciamiento. Por razones de economía procesal y dada la forma en que se ha resuelto, se omite pronunciamiento respecto a los otros motivos del recurrente.
POR TANTO:
Se declara con lugar el primer y segundo motivo del recurso de apelación presentado por la licenciada Yorleny Ching Cubero, en su condición de fiscal del Ministerio Público, al igual que el tercer motivo del recurso incoado por el licenciado Andrés Alfaro Ramírez, en su condición de Procurador Penal y, en consecuencia, se anula integralmente la sentencia impugnada, ordenando el juicio de reenvío ante el mismo Tribunal, con distinta integración, a fin de que celebren debate oral y público y resuelvan lo que corresponda en derecho.
