The Court annulled the decision granting the judicial-risk bonus without statutory authorization and ordered that payment cease only prospectively.

SummaryResumen

The Court upheld the State’s lesividad action against the MINAE decision granting an Environmental Administrative Tribunal employee an 18% salary bonus for risk in the exercise of judicial functions. It held that the Organic Environmental Law neither equates that Tribunal’s salaries with those of higher courts in the Judicial Branch nor authorizes the bonus. A substantive similarity between administrative and judicial duties cannot create a benefit payable from public funds when such expenditure is reserved to statute, given the principles of legality and financial legality. The Court also rejected defenses based on expiration, prescription, due process, and the labor and environmental non-regression principles. Regarding environmental non-regression, it found no demonstrated direct connection between eliminating the bonus and protecting the right to a healthy and ecologically balanced environment. The Court annulled the decision and its related acts but ordered discontinuance of the bonus only prospectively.

Key excerptExtracto clave

The Court considers that a grant of this nature, which affects the public treasury, must be expressly authorized by law; therefore, for persons serving in the Environmental Administrative Tribunal to receive the salary bonus at issue, the legislature must approve the expenditure after assessing whether the proposed equivalence is reasonable and well-founded. The defendant further argues that the lesividad proceeding violates the environmental non-regression principle. The Court does not accept that argument, however, because the record does not demonstrate how annulment of the judicial-risk bonus directly affects the defense and preservation of a healthy and ecologically balanced environment to such a degree that its elimination would violate the environmental non-regression principle. The defenses of expiration, prescription, violation of due process, violation of the labor and environmental non-regression principles, and lack of legal entitlement are rejected. The lesividad action brought by the State against Sandra Miranda Loría is upheld. Decision No. R-DRH-AJ-143-2009, issued at 8:30 a.m. on March 30, 2008, and its related acts are annulled, and the judicial-risk bonus granted to the defendant shall immediately cease to apply solely with prospective effect. The matter is decided without a special award of costs.

THE STATE DEFENDANT:

SANDRA MARIA DE LOS ANGELES MIRANDA LORIA N° 2025001885 ADMINISTRATIVE AND CIVIL COURT OF THE TREASURY, FIFTH SECTION, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at eleven hours and forty-nine minutes on ventiocho de Febrero del dos mil venticinco.- Injuriousness proceeding (proceso de lesividad) brought by THE STATE, represented by State Attorney EDGAR VALVERDE SEGURA, identity card 112490437, against Ms. SANDRA MIRANDA LORÍA, identity card 204100597, represented by SONIA MADRIGAL FERNÁNDEZ, professional license 3250, and NOEMY ZULAY LINKEMER FONSECA, license 3464. All persons appearing in these proceedings are of legal age.

RESULTS

I.By a brief filed with the Administrative and Civil Court of the Treasury on 11 de marzo del 2019, THE STATE brought an ordinary action for declaration of injuriousness against Ms. Sandra Miranda Loría and, based on the facts set forth and the legal grounds asserted, requests that the judgment declare:

“a. The absolute nullity (nulidad absoluta) of resolution N°R-DRH-AJ-143-2009 issued at 8:30 hours on 30 de marzo del 2008 by the Ministry of Environment and Energy, as well as of the related acts.

b. Once the nullity of resolution N°R-DRH-AJ-143-2009 and its related acts has been declared, the immediate inapplicability of the Judicial-Function Risk incentive (incentivo de Riesgo en el Ejercicio de la Función Judicial) in favor of the defendant shall be ordered.

c. The defendant shall be ordered to pay both categories of costs (ambas costas) and the interest accrued on those sums from the date they became due until actual payment” (see complaint at images 2 to 15 of the court case file).

II.By an order issued at 11:42 hours on 12 de marzo del 2019, the complaint was admitted for processing and served upon the defendant (see order admitting the case at images 59 and 60 of the court case file).

III.By a brief filed with the Court on 15 de mayo del 2019, the defendant denied the allegations of the complaint and raised the affirmative defenses (defensas) of lack of legal entitlement, defective filing of the complaint, violation of due process, violation of the principle of non-regression in environmental and labor matters, expiration (caducidad), and statute of limitations (prescripción) (see answer to the complaint at images 62 to 90 of the court case file).

IV.The preliminary hearing (audiencia preliminar) was held beginning at 08:55 hours on 31 de octubre del 2019. At that hearing, the claims were established as set forth in the complaint. Likewise, by resolution N°1976-2019, issued at 09:44, the judge presiding over the procedural stage denied the defense based on formal defects in the complaint and deferred the defenses of expiration and statute of limitations for determination in the judgment on the merits. The documentary evidence and the testimony of Mr. José Lino Chaves López were subsequently admitted.

V.The trial hearing (audiencia de juicio) for the presentation of testimonial evidence was held on 13 de enero del 2022. At that hearing, the parties were granted five business days to submit written closing arguments. Once that period had expired, judgment N°10-2022-V was issued at 8:30 hours on 04 de febrero del 2022 (images 273 to 294 of the court case file).

VI.In judgment N°001890-F-S1-2024, issued at 10:40 hours on 19 de diciembre del 2024, the First Chamber of the Supreme Court of Justice ruled: “By majority vote, the appeal is granted. The challenged judgment is reversed, and the case file is remanded to the court of origin so that it may issue the decision required by law. Justices Leiva Poveda and Zamora Campos dissent” (images 361 to 378 of the court case file).

VII.In issuing this judgment, no defects that could invalidate the proceedings are found. Judge Álvarez Molina and Judge Giusti Soto join in the decision. The opinion is authored by Presiding Judge Sánchez Navarro.

CONSIDERING

I. REGARDING THE PROVEN FACTS

The following facts relevant to deciding this matter are stated:

1. At the time this complaint was filed, Ms. Sandra Miranda Loría, in her capacity as an employee of the Ministry of Environment and Energy, held position N°036051, Civil Service Professional 3 classification, specializing in Law, at the Environmental Administrative Tribunal (see certification at images 21 to 23 of the court case file).

2. On 25 de febrero del 2008, Ms. Miranda Loría submitted a request to the Human Resources Department of the Ministry of Environment and Energy in which she stated: “Following instructions from my superiors and considering that, as of 11 de febrero del presente año, I perform duties at the Environmental Administrative Tribunal, I respectfully request that the appropriate steps be taken so that the Judicial-Function Risk incentive, which is already applied to its officials, may be applied to me” (see copy of the cited brief at image 136 of the court case file).

3. In resolution R-DRH-AJ-143-2009, issued at 08:00 hours on 30 de marzo del 2008, the then Minister of Environment and Energy, Mr. Jorge Rodríguez Quirós, granted “the administrative claim (reclamo administrativo) filed by Sandra Miranda Loría regarding the 18% salary supplement (Plus Salarial) known as Risk in the Exercise of the Judicial Function, corresponding to her position and the duties she performs.” This was based on Constitutional Chamber Vote N°1880-96, issued at 15:51 hours on 24 de abril de 1996, which granted that benefit to the members of the Fiscal Administrative Tribunal (see copy of the resolution at images 24 to 28 and 137 to 141 of the court case file).

4. By official letter DM-359-2014, dated 03 de septiembre del 2014, the then Minister of Environment and Energy, Mr. Edgar Gutiérrez Espeleta, submitted the following questions to the Office of the Attorney General of the Republic: “1. Is it appropriate to grant the risk incentive for the exercise of the judicial function to officials of the Environmental Administrative Tribunal? If so, who is eligible to receive it? 2. If the risk incentive for the judicial function was granted to officials of the Environmental Administrative Tribunal by means of an administrative resolution, what happens in the cases in which it is currently being paid? 3. At the end of the 06-year term for which the three members of the Environmental Administrative Tribunal are appointed, or if they are removed before the end of that term, must the Public Administration pay amounts for notice of termination (preaviso) and severance (cesantía)?” (see copy of the inquiry at images 154 and 155 of the court case file).

5. In Opinion C-257-2015, dated 16 de septiembre del 2015, the Office of the Attorney General of the Republic responded to the inquiry submitted by the Minister of Environment and Energy through official letter DM-359-2014, dated 03 de septiembre del 2014, referred to in the immediately preceding fact, and concluded: “If there is no law establishing salary parity (equiparación salarial) between the members of the Environmental Administrative Tribunal and the members of the Superior Courts of the Judiciary, the salary components granted to members of the Courts of the Judiciary, including the risk incentive for the exercise of the adjudicative function, cannot be granted to members of the Environmental Administrative Tribunal. It is not appropriate for the Ministry of Environment and Energy to recognize the risk incentive for the exercise of the judicial function as a vested right (derecho adquirido) of officials of the Environmental Administrative Tribunal, because it does not become a permanent component of the officials’ salaries but is instead subject to requirements or conditions, such as, in the case of Administrative Tribunals, the salaries and positions associated with their duties being made equivalent to the positions and salaries of the Judiciary.

Thus, if the public servant does not meet the established conditions, payment of the incentive must be denied and, if it has been granted by an administrative resolution, as is the subject of this inquiry, it must be discontinued. If the salary supplement (sobresueldo) was granted by means of an administrative resolution, the Administration must, in order to terminate it, follow the Procedure established in Article 173 of the General Law of Public Administration or, as applicable, in articles 10.5, 34, and 39.2 of the Code of Administrative Procedure” (see copy of the cited opinion at images 156 to of the court case file).

6. In resolution R-0188-2018-MINAE, issued at 12:19 on 13 de junio del 2018, the Ministry of Environment and Energy declared “...the act granting payment of the risk incentive for the exercise of the judicial function to Ms. Sandra Miranda Loría to be an act injurious to the State’s economic interests.” This was because that act was deemed to be based on an administrative resolution which, in turn, was based on Decreto Ejecutivo 34136 rather than on a provision having the force of law, as required by the legal system (see copy of the resolution at images 17 to 20 of the court case file).

7. In the case of the Environmental Administrative Tribunal, the Organic Environmental Law did not provide for salary parity between its members and the salaries of those serving on Courts within the Judiciary (that provision does not regulate the judicial-risk incentive).

II. REGARDING THE CLAIMANT’S ARGUMENTS

Counsel for the State states that Ms. Miranda Loría works at the Tribunal Ambiental Administrativo, where she holds the position of Civil Service Professional 3 (Profesional Servicio Civil 3), specializing in Law. Counsel indicates that, in response to a request submitted by the defendant, the Minister of Environment and Energy, by resolution N°R-DRH-AJ-143-2009, at 08:30 hours on 30 de marzo del 2008, approved in her favor an 18% incentive for Risk in the Exercise of the Judicial Function (Riesgo en el Ejercicio de la Función Judicial), which was granted through personnel action (acción de personal) N°509003257, effective 1° de mayo del 2009. Counsel explains that, in resolution N°R-0188-2018-MINAE, at 12:19 hours on 13 de junio del 2018, the Acting Minister of Environment and Energy declared the recognition of the incentive adverse to the interests of the State (lesivo a los intereses del Estado) and referred the case file to the Procuraduría General de la República to institute proceedings for annulment on grounds of harm to the public interest (proceso de lesividad).

Counsel notes that this case involves an act whose effects have continued over time, since the incentive has been granted to the defendant from 1° de mayo del 2009 to the present; for this reason, counsel considers that the one-year period established in the Código Procesal Contencioso Administrativo for issuing a declaration of harm to the public interest (lesividad) has not yet elapsed. Regarding the objective aspect, counsel argues that the act is substantially inconsistent with the legal system (ordenamiento jurídico), because the salary incentive for Risk in the Exercise of the Judicial Function was granted without legal basis, based on the erroneous conclusion that officials of the Tribunal Ambiental Administrativo perform duties similar to those of employees of the Poder Judicial. This conclusion was based on an interpretation of judgment N°1880-96 at 15:51 hours on 24 de abril de 1996, in which the Sala Constitucional determined that the salaries of employees of the Tribunal Fiscal Administrativo had to be placed on an equal footing with those of the Poder Judicial.

Counsel observes that the difference between those employees—as well as those working at the Tribunal Aduanero—and the present case is that, in those instances, a law expressly provides for salary parity (equiparación salarial). In support of this position, counsel cites judgment of the Sala Constitucional N°2012-3267 at 16:01 hours on 07 de marzo del 2012, in which that body stated that “...Public Administrations are subject to limitations when granting certain salary benefits that are not supported by statutory provisions.” Counsel clarifies that although Decreto Ejecutivo N°34136 del 20 de junio del 2007, which is the Reglamento de Procedimiento del Tribunal Ambiental Administrativo, granted its members compensation equal to the salaries of the Higher Courts of the Poder Judicial, the incentive at issue was not granted on the basis of that Decree, and the salary parity provided therein was repealed by Decreto Ejecutivo N°36035 “Reforma Reglamento de Procedimiento del Tribunal Ambiental Administrativo.” Counsel observes that, in Decreto N°34136, the Executive Branch exceeded its regulatory authority (potestad reglamentaria) by providing that the compensation of the members of the Tribunal Ambiental Administrativo had to be placed on an equal footing with the salaries of judges of the Higher Courts of the Poder Judicial, thereby exceeding the provisions of the Ley Orgánica del Ambiente, which, although it does not regulate this issue, could not have its existing gap filled by means of a Decree. Counsel further maintains that the act alleged to be null and void (nulidad) harms the public interest and the public treasury (erario público).

III. REGARDING THE DEFENDANT’S ARGUMENTS

For her part, the defendant argues that she did not apply for recognition of the salary incentive for risk in the exercise of adjudicative functions (riesgo en ejercicio de la función jurisdiccional), and maintains that it has formed part of her salary since she began working at the Tribunal Ambiental Administrativo. She states that the written request she submitted for recognition of that salary supplement (plus) was made pursuant to instructions given at the time by Mr. José Lino Chaves López, who was then President of the Tribunal. She notes that resolution N°R-0188-2018-MINAE, at 12:19 hours on 13 de junio del 2018, in which the declaration of harm to the public interest was made, was never served on her and therefore, in her view, constitutes an ineffective act (acto ineficaz). She explains that recognition of the salary incentive is a vested legal situation (situación jurídica consolidada) that created subjective rights (derechos subjetivos) in good faith, which must be assessed when determining the scope of forfeiture (caducidad) and the statute of limitations (prescripción).

She states that the State’s sole objection is that no law authorizes recognition of the incentive, but that it fails to consider that the Tribunal’s officials perform work similar to that carried out by judicial officials. Regarding voto 2012-3267, issued by the Sala Constitucional and cited by the claimant, she notes that the ruling concerns facts unrelated to the present matter involving a double salary incentive. She states that the amounts corresponding to the incentive were duly budgeted, without any showing of damage to the public treasury. She argues that “the application of the provisions governing the institutional guarantees (garantías orgánicas) of the Poder Judicial is attributable to the nature and functions of the Tribunal, which is independent and provides users with specialized administrative justice.” She adds that the incentive is not a privilege, just as it is not a privilege for employees of the Poder Judicial.

She asserts that it guarantees residents that administrative justice is independent and competent and that its officials are adequately compensated; she reiterates the similarity of the functions and states that “Administrative Tribunals perform an adjudicative function (función jurisdiccional).” Consistent with this position, she observes that the salary disparities between officials who administer justice in the Poder Judicial and those who do so from an administrative tribunal are unjustified. She also argued that resolution declaring harm to the public interest R-0188-2018-MINAE, at 12:19 hours on 13 de junio del 2018, was never served on her, which, she asserted, is an indispensable prerequisite for allowing the complaint to proceed. She raised the defenses (defensas) of defective filing of the complaint (defectuosa presentación de la demanda), lack of legal entitlement (falta de derecho), violation of due process (debido proceso), violation of the principle of non-regression in environmental and labor matters (principio de no regresión en materia ambiental y laboral), as well as the principle of equality (equal work, equal pay), forfeiture, and the statute of limitations.

IV. REGARDING THE REQUIREMENTS FOR A DECLARATION OF HARMFULNESS (DECLARATORIA DE LESIVIDAD)

In deciding cases similar to the one now under consideration, this Section of the Contentious-Administrative Court (Tribunal Contencioso Administrativo) has repeatedly stated the following: “Accordingly, since the purpose of these harmfulness proceedings (proceso de lesividad) is to analyze the validity of administrative acts (actos administrativos) having favorable content, it is necessary to establish briefly whether the various requirements imposed by the legal system for bringing proceedings of this nature have been met, given that the absence of any one of these elements would preclude and make it impossible to grant the relief sought in the complaint. It should be noted that the court must examine these requirements sua sponte (de forma oficiosa), as they are essential elements of the action. In general, harmfulness (lesividad) constitutes a judicial mechanism through which the Administration seeks to set aside an act of its own that, in principle, produces an effect favorable to a third-party recipient.

From that perspective, in proceedings of this type, harmfulness is subjective in nature insofar as it seeks the annulment of conduct that grants a right or, more generally, a beneficial status to a person. Although the validity of specific—and not general—public conduct having favorable content is reviewed, such review requires the participation of the recipient of that specific conduct so that the recipient may exercise the rights of defense and adversarial process (derecho de defensa y contradictorio) with respect to claims seeking to alter the recipient’s legal status. This mechanism is codified in section 34 of the Contentious-Administrative Procedure Code (Código Procesal Contencioso Administrativo), which establishes its prerequisites and procedural rules. It is also referenced, however, in section 173.6 in relation to section 183 of the General Law of Public Administration (Ley General de la Administración Pública).

From the standpoint of procedural prerequisites (presupuestos procesales), subjective, objective, procedural, and temporal conditions are imposed. With respect to the subjective aspect, standing to bring the action (legitimación activa) is conferred upon the Administration that issued the challenged act, while the party with standing to be sued (legitimado pasivo) is the recipient of the effects of the conduct, that is, the person who obtains its benefits. As to the objective aspect, harmfulness constitutes a mechanism for legally eliminating final administrative acts (actos administrativos firmes) of individual scope and favorable content that are substantially inconsistent with the legal system, that is, acts affected by some degree of invalidity, whether absolute or relative, in any of its forms (sections 128, 158, 165, and related provisions of the aforementioned General Law No. 6227).

Accordingly, the Administration must declare that conduct harmful to the public interest, which must be established through internal actions by the Administration that are indispensable to bringing the action. Indeed, as a procedural matter, the highest-ranking authority (jerarca máximo supremo) of the respective Public Administration must declare the act harmful, whether because it injures economic, fiscal, or other interests arising from the public interest; for that purpose, the authority must have an underlying legal and technical opinion supporting that determination. Unlike other mechanisms for setting aside public conduct (as in the case of sua sponte annulment (nulidad oficiosa) provided for in section 173 LGAP), this does not require a hearing for the affected third party, but only internal actions within the Administration intended to verify the existence of an express administrative decision issued by the highest-ranking authority seeking to set aside the act.

It is within the judicial proceedings that the recipient may present arguments in defense; therefore, the recipient’s lack of participation in the administrative stage of the declaration of harmfulness does not in any way impair the right to due process or administrative procedure (debido proceso o procedimiento administrativo). However, when the act originates from the State (see section 1 of the General Law of Public Administration), that is, from the Central Administration (Administración Central), the complaint may be filed only by the Procuraduría General de la República (section 16 of Law No. 8508), upon the prior request of the highest-ranking authority and following an internal declaration of harmfulness detailing the grounds for that determination. When the act originates from a public entity, the rules governing legal representation are those established in section 17 of that same code.

Regarding the temporal dimension, the new procedural legislation establishes a one-year period, calculated from the business day following issuance of the act (not its service), within which the act must be declared harmful to the public interest at the administrative level, unless its effectiveness was conditioned upon compliance with a requirement established by the legal system or by the formal conduct itself that is sought to be declared harmful, under sections 141.1 and 145.1 of the General Law of Public Administration. The foregoing does not apply where the act is affected by absolute nullity (nulidad absoluta) and has continuing effects, in which case, pursuant to section 34.1 of the Contentious-Administrative Procedure Code, the internal declaration may be made for as long as the act’s effects continue. In that scenario—an act affected by absolute nullity and having continuing effects—the one-year period is calculated from the cessation of its effects, and any judgment ordering its annulment shall do so solely for purposes of the future annulment and inapplicability of the conduct.

Following that declaration (and not upon expiration of that initial year), a period of one year is granted to bring the contentious-administrative action (acción contenciosa administrativa), as a strict limitation period (plazo fatal de caducidad), as provided in section 39 of the Contentious-Administrative Procedure Code. Any exception to this procedural rule must be expressly established by procedural legislation. (...) VII.- Regarding Failure to Satisfy the Temporal Requirement for the Internal Declaration of Harmfulness. As to the temporal element, it is important to note that section 34.1 of the CPCA establishes the time limits applicable to the stages of the procedure under review. The provision states: “...1) When the Administration itself, as the author of an act declaring rights (acto declarativo de derechos), seeks to bring an action for its annulment before the Contentious-Administrative Jurisdiction (Jurisdicción Contencioso-Administrativa), the highest-ranking hierarchical authority (superior jerárquico supremo) must first declare it harmful to public, economic, or any other interests.

The maximum period for doing so shall be one year, calculated from the day following the date on which it was issued, unless the act contains defects rendering it absolutely null, in which case that declaration may be made for as long as its effects continue...” (emphasis not in the original) (see, among others, the judgments issued by this Section N°73-2021-V, at 15:00 hours on 17 de agosto del 2021, and N°102-2021-V, at 13:23 hours on 26 de octubre del 2021).

V.SUBJECTIVE, OBJECTIVE, AND PROCEDURAL REQUIREMENTS FOR AN ACTION TO ANNUL AN ADMINISTRATIVE ACT ADVERSE TO THE PUBLIC INTEREST (LESIVIDAD) IN THIS SPECIFIC CASE: The record shows that, through official letter DM-359-2014, dated 03 de septiembre del 2014, the then Ministro de Ambiente y Energía, Mr. Edgar Gutiérrez Espeleta, submitted the following questions to the Procuraduría General de la República: “1. Is it appropriate to grant officials of the Tribunal Ambiental Administrativo the judicial-function risk incentive? If so, who is eligible to receive it? 2. If the judicial-function risk incentive was granted to officials of the Tribunal Ambiental Administrativo by means of an administrative decision, what happens in the cases in which it is currently being paid? 3. Upon expiration of the 06-year term for which the three members of the Tribunal Ambiental Administrativo are appointed, or if they are removed before the end of that term, must the Public Administration pay amounts for notice and severance?” The record also establishes that this Technical Advisory Body, in Opinion C-257-2015, dated 16 de septiembre del 2015, answered the questions submitted and concluded: “If there is no law establishing salary parity between the members of the Tribunal Ambiental Administrativo and the members of the Higher Courts of the Judiciary, the salary components granted to members of the Courts of the Judiciary, including the judicial-function risk incentive, may not be granted to the members of the Tribunal Ambiental Administrativo.

It is not appropriate for the Ministerio de Ambiente y Energía to recognize the judicial-function risk incentive granted to officials of the Tribunal Ambiental Administrativo as a vested right (derecho adquirido), because it does not become a permanent component of the officials’ salaries but is instead subject to requirements or conditions, such as, in the case of Administrative Tribunals, the requirement that the salaries and positions associated with their duties be placed on an equal footing with the positions and salaries of the Judiciary. Accordingly, if an employee does not meet the established conditions, payment of the incentive must be denied; and if it was granted by means of an administrative decision, as in the matter addressed by this consultation, it must be discontinued. If the additional compensation (sobresueldo) was granted by means of an administrative decision, the Administration must, in order to terminate it, follow the procedure established in Article 173 of the Ley General de la Administración Pública or, as applicable, in Articles 10.5, 34, and 39.2 of the Código Procesal Contencioso Administrativo.” Finally, the Tribunal has confirmed that, based on the technical opinion issued by the Procuraduría General de la República in Opinion C-257-2015, the Ministerio de Ambiente y Energía, in decision R-0188-2018-MINAE, issued at 12:19 on 13 de junio del 2018, declared “...the act granting Ms.

Sandra Miranda Loría payment of the judicial-function risk incentive to be an act adverse to the State’s economic interests.” The foregoing establishes compliance with the subjective requirement, as well as the procedural requirement, insofar as the record contains the legal and technical analyses on which the administrative authority based its decision to resort to this method of ex officio revocation of favorable administrative actions. Regarding the active subjective requirement, the internal declaration that the act was adverse to the public interest (declaratoria interna de lesividad) was issued by the head of the Ministerio de Ambiente y Energía. Moreover, the action is directed against the person who received the favorable effects of the challenged acts; therefore, there is likewise no deficiency concerning the passive subjective requirement. As to the objective requirement, the action must concern final acts conferring favorable rights.

Because the challenged actions, both principal and related, concern the granting of additional compensation for judicial risk to the defendant under decision R-DRH-AJ-143-2009, issued at 08:00 on 30 de marzo del 2008 by the then Ministro de Ambiente y Energía, the requirements established by the legal system have also been satisfied. It is clear that this administrative action, irrespective of whether it is valid, confers a benefit on the defendant by granting her a subjective right (derecho subjetivo) consisting of a salary incentive. Therefore, under the principle that an authority’s own acts are inviolable (intangibilidad de actos propios), derived from Article 34 of the Constitución Política, revocation on grounds of invalidity must be carried out in accordance with the procedure established by the Legal System for that purpose, such as the mechanism provided in Article 173 of the Ley General de la Administración Pública or, as in this case, through an action for annulment on grounds of adverse effect to the public interest.

For the foregoing reasons, the subjective, objective, and procedural requirements established by the legal system for such an action are deemed satisfied. At this juncture, it should be noted that the administrative power to annul acts declaring subjective rights is exceptional in nature; for that reason, the legal system establishes a procedure intended to ensure that this power is not exercised arbitrarily. Accordingly, when the nullity is not evident and manifest (nulidad evidente y manifiesta), the Ley General de la Administración Pública and the Código Procesal Contencioso Administrativo require the Administration concerned to bring an “administrative-litigation action for annulment of an act adverse to the public interest” (contencioso-administrativo de lesividad) to guarantee due process. It is in that proceeding that the party whose rights might ultimately be affected may participate and present a defense. Consequently, the fact that the affected party does not participate in the administrative proceeding preceding the judicial proceeding does not violate due process.

VI. COMPLIANCE WITH THE TIME REQUIREMENT FOR THE INTERNAL DECLARATION THAT THE ACT WAS ADVERSE TO THE PUBLIC INTEREST

Regarding the time requirement, it should be noted that subsection 1) of Article 34 of the Código Procesal Contencioso Administrativo establishes the time limits applicable to the stages of this proceeding: “...1) When the Administration itself, as the issuer of an act declaring rights, seeks its annulment before the Administrative Litigation Jurisdiction, the highest-ranking superior authority must first declare it adverse to public, economic, or other interests. The maximum period for doing so shall be one year, calculated from the day following the date on which it was issued, except where the act contains defects rendering it absolutely null and void (nulidad absoluta), in which case such a declaration may be made for as long as its effects continue...” (emphasis not in the original). The State’s representative argues that the acts challenged here have continuing effects because they grant the defendant a salary incentive that has been paid to her periodically, which in turn means that the action has not become time-barred by expiration (caducidad).

The Tribunal does not share this view, as it held when declaring the claim inadmissible in judgment N°10, issued at 08:30 on 04 de febrero del 2022. This was because it considered that the matter involved an act having an instantaneous effect, for the reasons stated in that judgment. Nevertheless, in judgment N°019890-F-S1-2024, issued at 10:40 on 19 de diciembre del 2024, the Sala Primera de la Corte Suprema de Justicia ruled: “By majority decision, the appeal is granted. The appealed judgment is reversed, and the case file is remanded to the Tribunal of origin for a decision in accordance with the law. Magistrados Leiva Poveda and Zamora Campos dissent.” Therefore, because the Sala Primera has already determined that the time requirement imposed by the legal system is satisfied in this case, the Tribunal shall now consider the parties’ arguments other than expiration of the action, which, as already stated, was finally resolved in the judgment issued by the Sala Primera.

Regarding the statute-of-limitations defense (prescripción) raised by the defendant, the Tribunal finds that this defense is inapplicable because this is an action for annulment of an administrative act adverse to the public interest, which is extinguished by expiration under the terms of Article 34 of the Código Procesal Contencioso Administrativo.

VII. ON THE NULLITY OF THE JUDICIAL-FUNCTION RISK INCENTIVE GRANTED TO THE RESPONDENT

According to the evidence contained in the case file (expediente), the Tribunal has established that, in connection with an administrative claim (reclamo administrativo) filed by the respondent Miranda Loría, through resolution R-DRH-AJ-143-2009, issued at 08:00 hours on 30 de marzo del 2008, the then Minister of Environment and Energy, Mr. Jorge Rodríguez Quirós, ordered that she be granted the “salary supplement (plus salarial) known as Risk in the Exercise of the Judicial Function (Riesgo en el Ejercicio de la Función Judicial), amounting to 18% based on her position and the duties she performs.” This was based on Sala Constitucional decision N°1880-96, issued at 15:51 hours on 24 de abril de 1996, which granted that benefit to the members of the Tribunal Fiscal Administrativo. However, after examining that decision, the Tribunal concludes that the interpretation placed on the Sala Constitucional’s ruling by the then Minister of Environment and Energy to justify granting the incentive was incorrect.

In the judgment in question—N°1880-96, issued at 15:51 hours on 24 de abril de 1996—the Sala Constitucional adjudicated an amparo action (recurso de amparo) brought by employees of the Tribunal Fiscal Administrativo, who alleged a violation of their right of petition (derecho de petición), recognized in Article 27 of the Constitución Política. At that time, they asserted that they had applied to the Dirección General del Servicio Civil for salary parity (equiparación salarial) under the terms established in Article 161 of the Código Tributario. In that matter, the Constitutional Tribunal held that the salary parity in question originated in a statutory mandate arising from the amendment of the aforementioned Article 161 of the Código Tributario, and that the Administration—in this case, the Dirección General del Servicio Civil—was failing to comply with the law, thereby also infringing the petitioners’ right to legal certainty (seguridad jurídica), as well as their right to have salary parity applied to them pursuant to the statutory provision establishing that the duties entrusted to employees of the Tribunal Fiscal Administrativo are substantively similar to those performed by judicial employees and requiring restoration of the salary equality established by the legislature.

Accordingly, the Constitutional Tribunal ordered that the applicants’ petition be resolved so that the parity process could be completed as required by law. Thus, the Sala Constitucional’s ruling, in which it noted the Administration’s resistance to addressing the application submitted by the employees of the Tribunal Fiscal Administrativo, was based on the fact that the legislature had already recognized, in Article 161 of the Código Tributario, their right to receive remuneration similar to that received by the members of multi-judge courts (tribunales colegiados) within the Poder Judicial. Therefore, although the judgment states that “officials of the Tribunal Fiscal Administrativo must receive salaries or wages equal to those for equivalent positions on certain courts of the Poder Judicial; that is, both groups must receive the same treatment with respect to remuneration for their work,” it also explained that this was so because the law presumes that similar duties are performed in those bodies.

Consequently, the judgment granted the action because the Sala found that, in this case—that of the members of the Tribunal Fiscal Administrativo—the Dirección General de Servicio Civil was disregarding a statutory provision that recognized such parity. Nevertheless, it cannot be concluded from the foregoing that entitlement to that salary component (componente salarial) automatically extends to all officials serving on administrative tribunals, because the positions covered by parity are solely those for which it is expressly recognized by a provision having the force of law (norma de rango legal). This is so because it must not be overlooked that public-employment relationships (relaciones de empleo público) are governed by the principle of legality (principio de legalidad), which imposes limitations on the elements comprising employees’ remuneration. In this regard, Article 48 of the Estatuto del Servicio Civil provides: “The salaries of officials and employees protected by this law shall be governed by the following rules: / a) No employee or official shall earn a salary below the minimum applicable to the position held. / b) The salaries of employees of the Poder Ejecutivo shall be determined by a Salary Law that shall establish the minimum, intermediate, and maximum amounts corresponding to each employment category. / c) In setting salaries, account shall be taken of fiscal conditions, the particular characteristics of each class of work, the cost of living in the different regions, the salaries prevailing in private enterprises for analogous positions, and the other factors stipulated in the Código de Trabajo. / d) Within the minimum and maximum amounts referred to in subsection b), the respective supervisors may approve salary increases based on factors such as efficiency, seniority, conduct, aptitude, and other qualities identified through the periodic evaluation of their employees, all subject to the provisions established for such purposes by the Salary Law.

The heads of the various administrative personnel sections must obtain the prior approval of their hierarchical supervisor for such increases, which shall be subject to subsection e) of this same article; and / e) The Tesorería Nacional is prohibited from issuing payment orders in favor of employees or officials for amounts other than the minimum amounts established in the Budget or Salary Law; and, in the case referred to in the preceding subsection, the increase shall not take effect unless it is included in the Ordinary Budget Law or in an extraordinary budget. The Dirección General de Servicio Civil shall inform the Tesorería Nacional of increases in public employees’ salaries.” Along the same lines, the Ley de Salarios de la Administración Pública N°2166 of 09 de octubre de 1957, which was in force for the case under consideration, states in Article 1: “This law is enacted to guarantee the efficiency of the Administration and shall constitute the compensation system for all classes of positions classified in the position-description manual, as provided in Chapter X of the Estatuto del Servicio Civil.” It follows from the quoted provisions that, in public-employment relationships, the various items comprising salary, or that must be considered in determining it as a whole, must be defined by law; accordingly, the only salary components that may validly be recognized are those arising from a provision having the force of law or those contained in a higher-ranking provision.

In this regard, the Sala Constitucional, in decision N°2012-003267 issued at 16:01 hours on 07 de marzo del 2012, when reviewing the constitutionality of Article 63 of the Reglamento Autónomo de Servicio del Ministerio de Hacienda, stated: “III.- On the merits. A.- On the public-employment relationship.- Since judgment No. 1992-01696 was issued, this Sala Constitucional has held on numerous occasions that the public-employment relationship is a public-law or statutory relationship (relación de derecho público o estatutaria), which entails inherent limitations on the application of ordinary labor law, such that not every act of generosity by the employer is permissible. Likewise, the Constitución Política of 1949 marks the point at which the public labor regime acquired force within the legal system, entailing strict subjection to Articles 11, 191, and 192 of the Constitución Política. Prior to 1949, the Constitución Política established nothing concerning the employment relationship between the State and public employees.

Furthermore, in resolution No. 2000-4453, the Sala more clearly established the limitations on collective bargaining (negociación colectiva) for officials who exercise public administration functions, as distinguished from those who do not, and the latter’s ability to access such collective-bargaining mechanisms. In this regard, the State and the public official are subject to a special relationship of subordination (relación de sujeción especial), which places the public official, within the employment relationship, in a situation very different from that of a worker in an ordinary employment relationship; in turn, the statutory relationship has particular implications for the Administración Pública. In a statutory relationship, the State occupies a position of preeminence over the public official, binding them throughout the entire public-employment relationship, which in turn is governed by a public-law framework (...).

Notwithstanding the foregoing, insofar as it is recognized that each Administración Pública may unilaterally establish particular benefits and conditions for employees, the Sala must examine more deeply the reasons why such benefits must at least be authorized within the body of legality and constitutionality (bloque de legalidad y de constitucionalidad); that is, they must have a legitimate basis compliant with the law or be established in a manner proportionate to the purposes pursued by the public service provided. (...). Now, once it has been determined that the service relationship between the Administración Pública and its public employees is statutory, the impact of unilaterally granted benefits on public resources cannot be disregarded, particularly where such benefits are often granted separately by sector without approval through a statutory provision. It is clear to the Sala that many administrative measures affect public finances, especially when they grant benefits, thereby becoming a means of circumventing a fundamental principle of public law: the principle of statutory reservation (principio de reserva de ley).

In this regard, certain obligations imposed on the Public Treasury must be assessed not only from an administrative standpoint but also from the standpoint of State economic policy, insofar as they burden public resources and the legislature plays a central role. In this regard, it is important to note that, on this issue, the Sala modifies its position, which has consequences for the precedents cited supra; that is, the Administraciones Públicas are subject to limitations when granting certain salary benefits that lack support in statutory provisions. B.- On the principle of statutory reservation.- There is no doubt that, under the principle of legality governing the Administración Pública, it may do only that which has previously been authorized by a provision of that nature and, consequently, may establish and regulate only what a statutory provision permits. Likewise, there are certain matters that only the legislature may properly regulate, because such regulation requires a provision that is both formally and substantively legislative and that satisfies the requirements governing its enactment, in accordance with the democratic principle; consequently, the Poder Ejecutivo may not regulate those matters autonomously.

In the terms previously stated by this Sala in judgment No. 1992-03550, it held: ‘Third, that not even through executive regulations, much less autonomous regulations or other lower-ranking rules or acts, could the law validly delegate the determination of regulations or restrictions that only the law itself was empowered to impose (...)’ For this reason, the regime governing fundamental rights is reserved to legislation.” Although the General Law of Public Administration authorizes and develops regulatory authority (potestad reglamentaria), the fact remains that when employment benefits (beneficios laborales) are granted that amount to leave (licencia) allowing officials to receive a salary without working, this effectively contravenes constitutional and statutory principles and rights, as it reverses the hierarchy of norms (jerarquía normativa). The other issue is that the Civil Service Statute regulates the vacation leave of public officials subject to the civil service system (régimen de servicio civil); however, in this Court’s view, a regulatory provision cannot expand a right governed by statute by using another legal institution (institución jurídica) that ultimately grants similar benefits.

In this regard, a lower-ranking provision could not modify statutory provisions establishing an orderly manner of administering and expending public resources, much less where it affects the principle arising from article 140 subsection 7) of the Political Constitution, which requires the President and the Government Minister to allocate national revenues in accordance with the law. It is therefore accepted that Public Administrations are governed by the principle of legality (principio de legalidad), which applies with even greater rigor under the principle of financial legality (principio de la legalidad financiera), given that public funds are involved. This principle is reflected in the management, administration, allocation, and custody of public resources; accordingly, through Ley No. 8131 de 18 de septiembre de 2001, Ley de Administración Financiera y Presupuestos Públicos, the legislature sets forth in artículo 5 various principles, including the principle of financial management (principio de gestión financiera).

The provision defines it as follows: “For the purposes of the preceding article, the following budgetary principles (principios presupuestarios) shall be observed: a)…b) Principle of financial management. The administration of the public sector’s financial resources shall be directed toward society’s general interests, in accordance with the principles of economy, effectiveness, and efficiency, and in full compliance with the law (...).” In this regard, the legislature incorporated into the legal system and developed within the Public Administration the principle of financial legality, fully consistent with artículo 140 inciso 7) de la Constitución Política, thereby precluding the unauthorized use of public resources based solely on the Public Administration’s discretion through an Autonomous Regulation (Reglamento Autónomo) or an act of public law (acto de Derecho público) not expressly authorized by statute.

The legislature specifically removed all doubt concerning the scope of the principle by categorically requiring full compliance with the law. Likewise, artículo 107, when referring to the principle of legality, states: “Administrative acts and contracts (actos y contratos administrativos) issued in matters of financial administration shall substantially conform to the legal system, in accordance with the hierarchy of its sources. The legality of the acts and operations of public bodies and entities subject to this law shall be presumed, but evidence to the contrary shall be admissible.” Consequently, they must substantially conform to the legal system, meaning that the Public Administration does not have unfettered discretion to create sources of expenditure; rather, statutory authorization is required. It is equally important to note that the financial obligations of the Public Treasury (Hacienda Pública) may arise from statute; they may likewise arise from judicial decisions (artículos 122 y 153 de la Constitución Política), and from administrative contracts and acts when obligations are based on particular expressions of the State’s will.

It is important to clarify, however, that such expressions cannot be understood from a private civil-law or employment-law perspective, not only for the reasons stated above, but because they concern contractual forms whose source lies specifically in statute or for which statute establishes the mechanisms for creating such financial obligations.” In the matter under review, the Court has deemed it a proven fact that, in resolution R-DSH-AJ-143-2009, the Ministerio de Ambiente y Energía granted Ms. Sandra Miranda Loría the judicial-function risk allowance (incentivo del riesgo de la función judicial), basing that action on the ruling of the Sala Constitucional 18880-96, which, as previously indicated, did not have the effect of extending the benefit provided for in numeral 161 del Código Tributario for the members of the Tribunal Fiscal Administrativo to other similar bodies within the Public Administration, because that ruling merely found that the respondent had unlawfully failed to comply with the statute establishing the allowance.

Thus, a benefit of this nature could be established only by statute, without prejudice, of course, to its recognition in judicial or administrative proceedings, including the establishment of a mandatory payment obligation, when this results from applying the statutory provision creating the benefit. That is not the case here, even though payment of the allowance known as Riesgo de la Función Judicial, amounting to 18%, plainly affects public funds. The Court considers that a grant of this nature, which affects the public treasury, must be expressly authorized by statute; therefore, for persons serving on the Tribunal Administrativo Ambiental to receive that salary allowance, the legislature must approve the expenditure after assessing whether the proposed equivalence is reasonable and whether it is justified. Accordingly, despite the respondent’s arguments that her work as a member of an administrative tribunal is equivalent to the functions performed by a judicial body and is similar to the work carried out by the Tribunal Fiscal Administrativo, that contention is irrelevant here, because her arguments cannot be accepted given that resolution R-DSH-AJ-143-2009, through which the Ministerio de Ambiente y Energía recognized her right to receive the salary allowance for judicial-function risk, was not authorized by statute.

The respondent further contends that the proceedings for a declaration of harmfulness to the public interest (lesividad) violate the principle of non-regression in environmental matters (principio de no regresión en materia ambiental). The Court does not accept that argument, however, because the record does not demonstrate how annulment of the judicial-risk allowance directly affects the protection and preservation of a healthy and ecologically balanced environment to such an extent that its elimination would violate that principle. Although this Body understands that the remuneration granted to public servants may affect the quality of their performance, those matters must be established before the appropriate authority so that the salary components necessary to ensure that officials provide excellent service may be recognized by statute. Nor can the arguments that the declaration of harmfulness violates the principle of non-regression in employment matters (principio de no regresión en materia laboral) be accepted, because it is clear that this principle protects validly acquired rights (derechos válidamente adquiridos), which are not present here: as stated above, the circumstances that gave rise in this case to the recognition of the judicial-risk allowance in favor of the respondent lack statutory support, an indispensable requirement for its validity.

VIII. DEFENSES

In light of the foregoing recitals, the appropriate course is to reject the defenses of expiration (caducidad), statute of limitations (prescripción), violation of the principles of due process and non-regression in labor and environmental matters, as well as the defense of lack of legal entitlement (falta de derecho); to declare Resolution N°R-DRH-AJ-143-2009 and its related acts null and void; and to order the immediate non-application of the Riesgo en el Ejercicio de la Función Judicial incentive with respect to the respondent solely as to future effects.

IX. COSTS

Pursuant to section 193 of the Código Procesal Contencioso Administrativo, court costs and attorney’s fees (costas procesales y personales) constitute a burden imposed on the unsuccessful party by virtue of having lost. Exemption from this award is permissible only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, this Collegiate Body considers that the respondent had sufficient reason to oppose the claim, since this proceeding is precisely the only avenue provided by the legal system for her to exercise her right of defense, as the law does not provide for her participation in the administrative stage of the declaration of adverse effect on the public interest (declaratoria de lesividad); moreover, under the principle of legitimate expectations (principio de confianza legítima), the respondent had grounds reasonably to conclude that she was entitled to receive the judicial-risk incentive, not only because the legal system grants it to public servants working in administrative bodies similar to the one of which she is a member, but also because her entitlement was expressly recognized by the head of the Ministerio de Ambiente y Energía.

POR TANTO

The defenses of expiration, statute of limitations, violation of the principles of due process and non-regression in labor and environmental matters, as well as the defense of lack of legal entitlement, are rejected. The action for annulment on grounds of adverse effect on the public interest (demanda de lesividad) brought by the State against Sandra Miranda Loría is granted. Resolution N°R-DRH-AJ-143-2009 of 8:30 a.m. on 30 de marzo del 2008, as well as its related acts, is annulled, and the immediate non-application of the Riesgo en el Ejercicio de la Función Judicial incentive with respect to the respondent is ordered solely as to future effects. This matter is decided without a special award of costs.

CONSIDERANDO
