Decision: 2025-0017 Case File: 08-000011-0033-PE (2) CRIMINAL JUDGMENT APPEALS COURT. Second Judicial Circuit of San José. Goicoechea, at nueve horas del ocho de enero de dos mil veinticinco.

APPEAL AGAINST JUDGMENT (RECURSO DE APELACIÓN DE SENTENCIA) filed in the present proceedings brought against [Nombre 001], [...]; [Nombre 002], [...]; [Nombre 003], [...]; [Nombre 004], [...]; [Nombre 005], [...]; [Nombre 006], [...]; and [Nombre 009], [...]; for the offense of BREACH OF OFFICIAL DUTY (PREVARICATO), to the detriment of THE DUTIES OF PUBLIC OFFICE. Judges Jorge Luis Arce Víquez, Manuel Gómez Delgado, and Ana Isabel Solís Zamora participated in the decision. Attorney Christian Hugo Barrero Godínez, Public Ethics Counsel; Attorney Carlos Manuel Jiménez Robleto, prosecutor for the Public Prosecution Service; and Attorney José Miguel Villalobos Umaña, private defense counsel, entered appearances before this Court.

BACKGROUND:

1°.– By judgment number 876-2023 issued at trece horas con treinta minutos del día veinte de noviembre de dos mil veintitrés, the Criminal Court of the Second Judicial Circuit of San José ruled: «THEREFORE: Pursuant to the foregoing and Articles 39 and 41 of the Political Constitution, 8 of the American Convention on Human Rights; 1, 30, 47, 69, 71, and 357 of the Criminal Code; and 1, 141 through 144, 324, 360, 361, and 364 through 366 of the Code of Criminal Procedure, this Court unanimously rules: Defendant [Nombre 008] is acquitted of all punishment and liability for the charged and privately prosecuted acts, characterized as constituting two offenses of BREACH OF OFFICIAL DUTY, which he had been alleged to have committed to the detriment of THE DUTIES OF PUBLIC OFFICE. Furthermore, defendants [Nombre 006] AND [Nombre 009] are acquitted of all punishment and liability for the acts charged against them as ACCOMPLICES in the commission of the offense of BREACH OF OFFICIAL DUTY, alleged to have been committed to the detriment of THE DUTIES OF PUBLIC OFFICE. Finally, defendants [Nombre 002], [Nombre 003], [Nombre 004], AND [Nombre 005] are acquitted of all punishment and liability for the charged and privately prosecuted acts, characterized as constituting one offense of BREACH OF OFFICIAL DUTY, alleged to have been committed to the detriment of THE DUTIES OF PUBLIC OFFICE. The costs of the criminal proceedings shall be borne by the State. Any precautionary measure (medida cautelar) ordered against the defendants herein in connection with this case is hereby terminated. 2°.– Attorney Christian Barrero Godínez, Public Ethics Counsel, and Attorney Carlos Manuel Jiménez Robleto, prosecutor for the Public Prosecution Service, each filed an appeal against the foregoing ruling. At the request of counsel for defendant [Nombre 001], a hearing was held at 9:30 horas del 30 de setiembre de 2024.

3°.– Following the corresponding deliberation, pursuant to Article 465 of the Code of Criminal Procedure, the Court considered all the issues raised in the appeal.

4°.– The relevant legal requirements have been observed throughout the proceedings.

Criminal Judgment Appeals Judge Arce Víquez authors the decision; and

CONSIDERING:

I.Background. For a better understanding of the issues to be decided, it is necessary to summarize the background of the case. The Criminal Court of the Second Judicial Circuit of San José, Goicoechea, issued judgment N° 32-2015 at 10:00 horas del 28 de enero de 2015, which provided:

«THEREFORE Pursuant to Articles 39, 41, 140, and 146 of the Political Constitution; Articles 1, 9, 37 through 41, 180 through 184, 324 through 367, and 376 through 379 of the Code of Criminal Procedure; 1, 57, 58, 59 through 63, 71, 74, 357, and 365 of the Criminal Code; 3 and 84 of the Mining Code; 164, 187, 188, 189, and 361 of the General Public Administration Act; 6, 17, and 22 of the Organic Environmental Act; 3 subsection m, 19, and 34 of Ley Forestal; and 2 of the Regulations to Ley Forestal, [Nombre 001] is unanimously found criminally responsible as the principal perpetrator of ONE offense of BREACH OF OFFICIAL DUTY in connection with Decreto Ejecutivo 34801-MINAS, to the detriment of THE DUTIES OF PUBLIC OFFICE, and is therefore sentenced to THREE YEARS’ IMPRISONMENT, which sentence he shall serve, with credit for time spent in pretrial detention, at the place and in the manner prescribed by the applicable prison regulations. [Nombre 001] is DISQUALIFIED (INHABILITACIÓN) from holding public office for THREE YEARS. [Nombre 001], [Nombre 006], [Nombre 009], [Nombre 002], [Nombre 003], [Nombre 004], and [Nombre 005] are acquitted of all punishment and liability for one offense of Breach of Official Duty. Because [Nombre 001] qualifies therefor, he is granted the benefit of a suspended sentence (ejecución condicional de la pena) for a period of FIVE years, during which he shall not commit an intentional offense punishable by imprisonment exceeding six months; if he does so, the benefit granted herein shall be revoked and he shall be required to serve the sentence imposed. Once the judgment becomes final, it shall be entered in the Judicial Registry of Offenders, and notice shall be given to the Instituto Nacional de Criminología and the Sentence Enforcement Court. Notice shall be provided by reading aloud. Hugo Porter Aguilar. Mercedes Muñoz Campos. Sergio Quesada Carranza. Judges» (sic).

That same court, by decision issued at 13:05 horas del 19 de marzo de 2015, supplemented judgment N° 32-2015 and ruled:

«THEREFORE Accordingly, pursuant to Articles 15 and 147 of the Code of Criminal Procedure, the judgment issued at diez horas del veintiocho de enero del año dos mil quince is supplemented so that, on pages 182, 190, and 217 of the judgment in question, the word “breach of official duty” shall appear instead of the word “embezzlement.” The request by counsel for defendant [Nombre 001] for clarification and supplementation is denied. Notice shall be given. Hugo Porter Aguilar - Mercedes Muñoz Campos - Sergio Quesada Carranza» (sic).

Defendant [Nombre 001]; his private defense counsel, Attorney Laureano Castro Sancho; Attorney Natalia Rojas Méndez, prosecutor for the Public Prosecution Service; and Attorney Ronald Víquez Solís, representing the Procuraduría General de la República, each filed an appeal against judgment N° 32-2015 issued at 10:00 horas del 28 de enero de 2015. By decision N° 2015-1539 issued at 13:30 horas del 19 de noviembre de 2015, the Criminal Judgment Appeals Court ruled:

«THEREFORE: The appeals filed are declared admissible. The appeals lodged by Attorney Luis Diego Hernández Araya and Attorney Natalia Rojas Méndez, as prosecutors for the Public Prosecution Service, and by Attorney Ronald Víquez, representing the Procuraduría General de la República, are granted in full, and those filed by Attorney Laureano Castro Sancho, as counsel for [Nombre 001], and personally by that defendant are granted in part. Accordingly, the plea of constitutional res judicata (cosa juzgada constitucional) is denied, and both the judgment and the trial preceding it are vacated in their entirety. The case is remanded for a newly constituted trial court to issue the ruling required by law, with due observance of the prohibition against reformatio in peius (prohibición de reforma en perjuicio) solely with respect to the acts for which [Nombre 001] was convicted in the judgment vacated herein, as well as the tacit abandonment of the criminal action by the Procuraduría General de la República concerning two defendants previously acquitted, because that entity did not appeal. As unnecessary, no ruling is issued regarding the failure to award costs in connection with the acquittals. The trial court shall take note of the matters stated in Considering VII. NOTICE SHALL BE GIVEN. Rosaura Chinchilla Calderón - Joe Campos Bonilla - Lilliana García Vargas - Judges» (sic).

Against this background, the Criminal Court of the Second Judicial Circuit of San José issued judgment N° 876-2023 at 13:30 horas del 20 de noviembre de 2023—the operative portion of which is described in Background 1° of this decision—which is the subject of the two appeals now before us, filed by the Public Prosecution Service and the Procuraduría General de la República.

Regarding the formal admissibility of those two appeals, this Judgment Appeals Court, by decision N° 1289 issued at 14:30 horas del 6 de agosto de 2024, ruled:

«The appeals filed by the Public Prosecution Service and the Procuraduría General de la República are admitted in part, solely insofar as judgment N° 876-2023 acquitted defendant [Nombre 001] in connection with Decreto Ejecutivo N° 34801-MINAET issued at 13:00 horas del 13 de octubre de 2008, published in La Gaceta N° 201 del 17 de octubre del 2008, which declared Proyecto Minero Crucitas to be in the public interest and of national benefit. Pursuant to Article 466 bis of the Code of Criminal Procedure, the challenges directed against judgment N° 876-2023 are inadmissible insofar as that judgment reaffirms the acquittal of defendants [Nombre 009], [Nombre 006], [Nombre 004], [Nombre 005], [Nombre 002], and [Nombre 003] for the acts charged against them, and insofar as it reaffirms the acquittal of defendant [Nombre 001] for one of the offenses of breach of official duty charged against him (the offense relating to Decreto Ejecutivo N° R-217-2008-MINAE)...»

II. APPEAL BY THE PUBLIC PROSECUTOR’S OFFICE

Licenciado Carlos Manuel Jiménez Robleto, a prosecutor with the Public Prosecutor’s Office, filed an appeal (recurso de apelación) against the judgment rendered by the criminal trial court in the retrial (juicio de reenvío), N° 876-2023 at 13:30 hours on 20 de noviembre de 2023. The appellant maintains that, given that this second judgment reiterated, on the one hand, the acquittal of defendants [Nombre 004], [Nombre 005], [Nombre 002], and [Nombre 003] with respect to the acts charged against them and, on the other hand, also reiterated the acquittal of defendant [Nombre 001] of one of the two offenses of malfeasance in office (prevaricato) charged against him (the one concerning the issuance of Decreto Ejecutivo N° R-217-2008-MINAE at 15:00 hours on 21 de abril de 2008), the amendment made to Article 466 bis of the Code of Criminal Procedure (Código Procesal Penal, hereinafter CPP) by the sole article of Ley N° 10200 of 5 de mayo de 2022 is not applicable in this case; that amendment provides that the Public Prosecutor’s Office, the private complainant (querellante), and the civil claimant (actor civil) may not appeal a trial court judgment rendered in a retrial when it reiterates the acquittal of the defendant ordered in a previous trial.

He argues that this follows from the position adopted by the Third Chamber regarding the non-retroactivity of procedural law. He notes that the previous judgment of acquittal (N° 32-2015 at 10:00 hours on 28 de enero de 2015) was rendered long before the aforementioned amendment to Article 466 bis CPP. In his appeal, the prosecutor includes extensive quotations from the dissenting opinion (voto salvado) of Justice Salazar Alvarado in Constitutional Chamber decision N° 2023-8843, to the effect that the principle of retroactive application of the more favorable criminal rule refers solely to substantive law, not to procedural law. To the same effect, he also cites decisions of the Third Chamber of the Supreme Court of Justice (N° 1993-416 at 10:50 hours on 30 de setiembre de 1993; N° 2002-883 at 13:40 hours on 12 de setiembre de 2002; N° 2004-115 at 10:10 hours on 20 de febrero de 2004; N° 2005-1422 at 10:15 hours on 7 de diciembre de 2005; and N° 2022-680 at 10:24 hours on 24 de junio de 2022).

He adds that the principle of two consistent judgments (principio de doble conformidad) established in Article 466 bis CPP has not become operative in this case because, under the principle tempus regit actum (a Latin phrase meaning in Spanish “time governs the act”), the applicable rule would be the one in force when the adjudicated act occurred. He therefore concludes that the amendment made to Article 466 bis CPP is inapplicable because it is clearly procedural in nature and the first acquittal was rendered on 28 de enero de 2015, long before the 2022 statutory amendment. He notes that his appeal was filed within the 30-day period established for complex-case proceedings (procedimiento para asuntos de tramitación compleja) in Articles 378(e) and 460 CPP. Prosecutor Jiménez Robleto states that the Public Prosecutor’s Office was prejudiced by the acquittal of defendants [Nombre 001], [Nombre 004], [Nombre 005], [Nombre 002], and [Nombre 003] of all punishment and liability, and therefore requests that the judgment be vacated and that a retrial be ordered for fresh proceedings.

It must be borne in mind, as noted earlier in Considerando I of this decision, that this Court of Appeal for Criminal Judgments, by decision N° 1289 at 14:30 hours on 6 de agosto de 2024, partially admitted the appeal filed by the Public Prosecutor’s Office solely insofar as judgment N° 876-2023 acquitted defendant [Nombre 001] in connection with Decreto Ejecutivo N° 34801-MINAE at 13:00 hours on 13 de octubre de 2008, published in La Gaceta N° 201 of 17 de octubre del 2008, which declared Proyecto Minero Crucitas to be in the public interest and a matter of national benefit. Furthermore, pursuant to Article 466 bis of the Code of Criminal Procedure, the claims directed against judgment N° 876-2023 were declared inadmissible insofar as that judgment reiterates the acquittal of defendants [Nombre 009], [Nombre 006], [Nombre 004], [Nombre 005], [Nombre 002], and [Nombre 003] regarding the acts charged against them, and insofar as it reiterates the acquittal of defendant [Nombre 001] of one of the offenses of malfeasance in office charged against him (the one concerning Decreto Ejecutivo N° R-217-2008-MINAE). Accordingly, hereinafter the claims raised by the Public Prosecutor’s Office will be addressed solely with respect to the issue that was admitted.

III.First ground of appeal by the Public Prosecutor’s Office. Regarding the acquittal of [Nombre 001] for the offense of malfeasance in office, alleged to have been committed through Decreto Ejecutivo N° 34801-MINAE, prosecutor Carlos Manuel Jiménez Robleto alleges a violation of Articles 31, 45, 357, and 363 CPP due to “Disagreement with the legal reasoning.” He argues that the trial court erred in finding that Mr. [Nombre 001]’s conduct did not constitute an offense (atípica) because he did not act with criminal intent (dolo). The judgment contains an error in its legal reasoning by concluding that one reason criminal intent was absent was that the Public Prosecutor’s Office was unable to establish a meeting of the minds among the defendants to commit the offense of malfeasance in office. Although it is true that there is no evidence of a meeting of the minds between [Nombre 001] and the members of the Comisión Plenaria to sign each of the unlawful decisions—the appellant states—that element need not be proven to establish criminal intent, since neither co-perpetration (coautoría) nor complicity (complicidad) was charged.

IV.Second ground of appeal by the Public Prosecutor’s Office. A violation of Articles 142, 182, 183, 303, 304, 349, 351, and 352 CPP is alleged due to “Disagreement concerning the admission and assessment of evidence.” The prosecutor argues that, regarding the illegality of Decreto de Conveniencia Nacional N° 34801-MINAE, one of the criminal trial court’s grounds for acquitting defendant [Nombre 001] was that no political or improper pressure to grant the Proyecto Crucitas concession had been proven. Nevertheless, the court “cut off” or “buried” the Public Prosecutor’s Office’s opportunity to demonstrate that the Executive Branch had indeed exerted pressure for the Proyecto Crucitas concession to be granted. This occurred because the criminal trial court decided to classify [Nombre 010] and [Nombre 011] as suspect witnesses (testigos sospechosos). (This related to the testimony of [Nombre 012], director of Área de Conservación Arenal Huetar Norte.) Don [Nombre 010], who had been a geologist with the Dirección de Geología y Minas, would have testified about everything related to the approval of the mining concession in favor of Industrias Infinito S.A. and the scope and limitations of the national moratorium decree.

Don Eduardo would have testified that, in 2008, he had served as head of the San Carlos, Los Chiles subregion and, pursuant to directives from Mr. [Nombre 001], had been summoned to an urgent meeting at MINAE so that the forestry permits in favor of Industrias Infinito could be finalized, including a decision to issue the national-benefit decree, as well as Mr. [Nombre 001]’s knowledge of the matter. For the Public Prosecutor’s Office, that testimony was essential to prove its theory of the case: that political pressure had been exerted to approve the concession; that Mr. [Nombre 001] knew the details of the project and the difficulties it was encountering; and that it was facing resistance from SINAC (Sistema Nacional de Áreas de Conservación), which would not grant the land-use change permit (permiso de cambio de suelo). When the examination of each of these witnesses was about to begin, one of the defendants’ counsel requested that they be treated as suspect witnesses, alleging that they might have been involved in some of the actions described in the facts charged by the Public Prosecutor’s Office or the Procuraduría General de la República.

The Public Prosecutor’s Office opposed the request, finding it necessary to hear the witnesses because the alleged facts disclosed no criminal liability on their part and, therefore, no prior assessment could be made without first hearing them. The criminal trial court did not accept that position; instead, it granted defense counsel’s requests and prematurely determined that those witnesses were indeed considered suspects. It therefore requested that defense counsel be appointed for each of them, which resulted—because counsel had little time to review the case file—in counsel advising the witnesses to refrain from testifying; as laypersons, the witnesses accepted that advice. The Public Prosecutor’s Office concludes that there was no basis for the trial court to find that examining these witnesses could incriminate them. It therefore should have allowed the examination and, had any self-incriminating statement arisen, suspended the questioning and appointed defense counsel at that time to advise the witness.

Nevertheless, the court considered those individuals to be suspect witnesses solely because defense counsel for the defendants had so requested, granting those requests without any basis whatsoever, even though the Public Prosecutor’s Office itself had not characterized them as such.

V.Third ground of appeal by the Public Prosecutor’s Office. It alleges failure to comply with Articles 142, 184, and 363(b) of the Code of Criminal Procedure, due to “Disagreement with the assessment of the evidence, specifically for lack of reasoned analysis [...] because the judgment omitted analysis of the circumstantial evidence (indicios) [...] which, had it been analyzed, would have demonstrated that the defendants committed the offense of malfeasance in office (prevaricato).” Prosecutor Jiménez Robleto criticizes the criminal court’s conclusion that the defendant [Nombre 001] signed Decreto Ejecutivo N° 34801-MINAE without knowing that it was unlawful. The appellant emphasizes that this decree is unlawful and that what makes it contrary to the legal system is its reliance on the purported existence of a cost-benefit study establishing that the social and economic benefit outweighed the environmental harm that would be caused by clearing the forest.

Accordingly, the court’s argument that the various legal departments of SETENA (Secretaría Técnica Nacional) and SINAC (Sistema Nacional de Áreas de Conservación) had doubts as to whether a National Convenience Decree (Decreto de Conveniencia) was required for granting approval for land use (uso del suelo) is unrelated to the alleged facts, because that issue is not part of the factual allegations. The court’s argument that Mr. [Nombre 001] was entirely unaware of the decree’s contents is based solely on this defendant’s statement, while disregarding the other testimonial and documentary evidence that clearly shows the role he played, as minister of MINAE (Ministerio de Ambiente y Energía), in enabling Industrias Infinito to obtain the operating concession (concesión de explotación) for the Crucitas project. His first involvement in the project occurred on 21 de noviembre de 2007, when, in his capacity as minister, he filed a motion to supplement and clarify (solicitud de adición y aclaración) judgment N° 13414-2004 of the Sala Constitucional, seeking to determine whether or not the Sala had annulled the concession for the Crucitas project.

Subsequently, on 3 de marzo de 2008, then-president Oscar Arias Sánchez and Minister [Nombre 001] annulled resolution R-613-2007-MINAE, which had granted a motion for reconsideration (recurso de reposición) and declared the MINAE concession for the Crucitas project null and void. However, instead of upholding that resolution, the defendant [Nombre 001] archived it without ruling on it, declaring that the motion lacked a current legal interest (interés actual). On 18 de abril de 2008, President Arias Sánchez and Minister [Nombre 001] signed decree 34492, which repealed the nationwide moratorium on metallic gold-mining activity (30477-MINAE), published on 4 de junio de 2008; and almost immediately, on 21 de abril de 2008, the accused [Nombre 001], in his capacity as Minister of MINAE, ordered the conversion of the act granting the mining concession (conversión del acto de otorgamiento de la concesión minera), even though the Sala Constitucional had already annulled that concession.

Following the refusal of Área de Conservación Huetar Norte to issue the land-use permit (permiso de uso de suelo) without a national-convenience decree providing a basis for it, on 13 de octubre de 2008 the defendant [Nombre 001] signed Decreto Ejecutivo N° 34801-MINAE, and it was published in La Gaceta on 17 de octubre. This demonstrates the defendant’s active participation at various stages of the Crucitas project, a circumstance that the criminal court did not analyze in its judgment. Another piece of circumstantial evidence is the short period within which the convenience decree was processed. The court did not analyze the fact that Industrias Infinito submitted the application for land-use change (cambio de uso de suelo) on 9 de setiembre de 2008. Decreto Ejecutivo N° 34801-MINAE was drafted on 13 de octubre de 2008, and authorization for the land-use change and tree felling was granted on 17 de octubre.

In the opinion of the Public Prosecutor’s Office, the national-convenience decree was drafted with knowledge that it lacked the requirements needed to substantiate it, solely to satisfy the demand of Área de Conservación Huetar Norte so that the latter would grant the land-use-change permit. The study weighing the social and economic benefit against the environmental harm could not have been completed in less than one month. Nor did the court analyze the irregular manner in which the national-convenience decree was processed, according to witness [Nombre 013], who, at the time of the events, worked as director of the Dirección de Leyes y Decretos and stated that it arrived at her office already signed by President Arias Sánchez. Witness [Nombre 014], who worked in SINAC’s legal department, identified another irregularity because the department was never asked to provide its approval or endorsement (aval o visto bueno) regarding the cost-benefit study requirement. The prosecutor concludes that, had these items of evidence been analyzed, the criminal liability of the defendant [Nombre 001] would have been established.

VI. APPEAL BY THE PROCURADURÍA GENERAL DE LA REPÚBLICA

Attorney Christian Hugo Barrero Godínez, Procurador de la Ética Pública, filed an appeal against judgment N° 876-2023, issued by the criminal court in the retrial on remand (juicio de reenvío) at 13:30 hours on 20 de noviembre de 2023. At the outset, he states that his appeal is directed solely against the acquittal of the defendant [Nombre 001] concerning Decreto Ejecutivo N° 34801-MINAE del 13 de octubre de 2008, publicado en La Gaceta N° 201 del 17 de octubre del 2008, which declares the Proyecto Minero Crucitas to be in the public interest and nationally advantageous (interés público y conveniencia nacional). He maintains that the criminal court acquitted the defendant [Nombre 001] because it erroneously considered the evidentiary material offered and admitted at trial insufficient to establish the volitional element (elemento volitivo) of the offense of malfeasance in office, namely, his knowledge of and intent regarding the unlawful aspects of the National Convenience Decree for the Proyecto Minero Crucitas that he signed.

He raises two grounds for challenge and requests that the grounds of appeal be sustained insofar as the defendant [Nombre 001] was acquitted of all punishment and liability for the charged offense of malfeasance in office in connection with the decree declaring the Proyecto Minero Crucitas to be in the public interest and nationally advantageous; that judgment N° 876-2023 be declared ineffective; and that the proceedings be remanded for a new adjudication. First ground. He alleges violation of Articles 142, 182, 183, 303, 304, 349, 351, and 352 of the CPP due to “Violation of the principles of immediacy and adversarial proceedings (principios de inmediación y contradicción), through prejudgment (adelanto de criterio).” He makes this allegation in connection with the testimony of [Nombre 010] (a geologist with the Dirección de Geología y Minas of MINAE, who would testify about everything related to the approval of the mining concession in favor of Industrias Infinito, the scope and limitations of the national moratorium decree, and the conversion of the act granting the mining concession); [Nombre 012] (director of Área de Conservación Arenal Huetar Norte, who would testify that in 2008, while serving as Director of Área de Conservación Arenal Huetar Norte, he was summoned to an urgent meeting at MINAE so that the forestry permits in favor of Industrias Infinito could be finalized, including making the decision to issue the national-convenience decree, as well as regarding Mr. [Nombre 001]’s knowledge of the matter); and [Nombre 011] (who would testify that in 2008 he had served as Head of Subregión San Carlos Los Chiles and that, pursuant to instructions from Mr. [Nombre 001], he was summoned to an urgent meeting at MINAE so that the forestry permits in favor of Industrias Infinito could be finalized, including making the decision to issue the national-convenience decree, as well as regarding Mr. [Nombre 001]’s knowledge of the matter).

When the examination of each of these witnesses was about to begin, counsel for one of the defendants requested that they be treated as suspect witnesses (testigos sospechosos), alleging that they might have been involved in some of the actions described in the facts alleged by the Public Prosecutor’s Office and the Procuraduría General de la República. The representatives of those two entities objected for the reasons established in the case law: the judges may not prejudge the matter until the witnesses’ own accounts show whether self-incrimination (autoincriminación) exists. The criminal court did not follow that criterion; instead, it granted the defense requests and determined in advance that those witnesses were indeed considered suspects, and therefore requested that counsel be appointed for each of them. For obvious reasons of time, defense counsel chose the safest and quickest course, which was to advise their clients to refrain from testifying, without thoroughly determining whether the purported suspect witnesses were involved.

He therefore considers that the criminal court acted arbitrarily by making unfounded prejudgments before the witnesses had incriminated themselves, thereby restricting the Public Prosecutor’s Office’s and the Procuraduría General de la República’s access to the evidence. He emphasizes that there was no objective information in this case indicating that their examination at trial would lead these witnesses to incriminate themselves; that the existence of self-incrimination must be determined from the witnesses’ own accounts and not in advance, as occurred here through prejudgment. The court considered those persons suspects merely because the defendants’ counsel requested it, granting those requests without any basis and prejudging the matter, even though the Public Prosecutor’s Office had not characterized them as such or pursued any investigation against them. They are merely mentioned in the alleged facts, but no criminal act is attributed to them, and therefore nothing prevented their testimony from being heard.

The court’s conduct “buried” evidence that was fundamental to the Public Prosecutor’s Office and the Procuraduría General de la República by unjustifiably giving those witnesses the legal warnings before hearing their statements at trial. This harmed the State’s interests in its role as a criminal complainant (actor penal), because it “improperly excluded evidence that could have been essential to establish the intentional element (elemento doloso) of the offense of malfeasance in office, which the court itself states in the judgment was not, in its view, established by the evidence admitted at trial, because the court’s own actions violated the principles of immediacy and adversarial proceedings by arbitrarily dispensing with this evidence.”

VII.Second ground of appeal by the Procuraduría General de la República. It alleges a violation of Articles 142, 182, and 184 of the Código Procesal Penal due to a “Lack of intellectual reasoning in the assessment of the evidence (valoración de la prueba).” It argues that the court failed to comply with those provisions because, instead of stating the reasons why it assigned a particular weight to the evidence, it merely explained why it considered that there was neither direct evidence nor sufficient circumstantial evidence (indicios) to establish the volitional element (elemento volitivo) of the statutory definition of the offense (tipo penal) of malfeasance in office (prevaricato), without determining what weight it assigned to the evidence duly offered and admitted at trial. It merely transcribed the testimony received at trial and did not assess the inferences arising from the evidence, which demonstrate the irregularities in the processing, signing, and publication of the decree declaring the Crucitas Mining Project to be in the public interest and of national convenience, N° 34801 of October 13, 2008.

Those irregularities reveal the defendant’s intention to expedite the decree’s approval process and thereby avoid review by other departments involved in that process, so that the absence of the requirements necessary to issue the declaration of national convenience would not become known.

The witnesses [Nombre 014], [Nombre 018], and [Nombre 015] concur in identifying the irregularities in decree N° 34801, which was required to be based on a cost-benefit study that was to form part of the decree’s statement of reasons; it may reasonably be inferred that the defendant, who was Minister of the Environment, knew of that deficiency.

Another irregularity in the decree’s approval was the urgency with which it was processed, an aspect mentioned by witnesses [Nombre 015], [Nombre 016], [Nombre 017], and [Nombre 013], and consistent with the documentary evidence offered and admitted at trial. That evidence demonstrates how quickly the decree was published: it was issued on October 3, 2008, and by October 17 of that same year it had already been published in La Gaceta N° 201, on the same day that the application for land-use change (cambio de uso de suelo) was approved by Área de Conservación Arenal Huetar Norte.

Based on the testimony indicated above, the irregularities in the process for approving decree N° 34801 may be deemed established. The expedited procedure is clear circumstantial evidence of the defendant’s intention to favor the Crucitas Mining Project and evade review, such as the review conducted by the Dirección de Leyes y Decretos when the decree arrived signed by President Arias Sánchez.

Accordingly, the criminal court erred in basing the acquittal on an alleged absence of direct or circumstantial evidence proving the subjective element of the offense of malfeasance in office, because the circumstantial evidence would indeed establish that the defendant [Nombre 001] knew of the deficiencies and illegalities in the decree he signed. Under the principle of freedom of proof (libertad probatoria), it could indeed be demonstrated in this case that the accused acted with criminal intent (dolo), based on a comprehensive and harmonious analysis of the testimonial and documentary evidence, which the criminal court failed to perform, thereby causing harm to the State, specifically to the Duties of Public Office and to the environment. It therefore requests that the challenged judgment be declared ineffective and that the case be remanded for new proceedings.

VIII.Resolution of the claims raised. As previously stated in Considerandos I and II of this decision, the appeals filed by the Ministerio Público and the Procuraduría General de la República were formally admitted—by operation of Article 466 bis of the Código Procesal Penal—solely insofar as judgment N° 876-2023 acquitted the defendant [Nombre 001] in connection with the issuance of Decreto Ejecutivo N° 34801-MINAE at 13:00 hours on October 13, 2008 (published in La Gaceta N° 201 of October 17, 2008), which declared the Proyecto Minero Crucitas to be in the public interest and of national convenience.

Within those limits, it is apparent that the grounds raised in both appeals share, in essence, a criticism of the court’s analysis and assessment of the evidence concerning the determination of the knowledge and intent that guided the conduct of the defendant [Nombre 001], as well as a challenge regarding the effect that the criminal court’s conclusions on that matter had on the application of substantive law. Both appellants consider that a proper examination of the evidence would have yielded a series of circumstances which, taken together, would support with certainty the conclusion that the defendant [Nombre 001] knowingly and intentionally issued Decreto Ejecutivo N° 34801 despite knowing that it was a decision contrary to law or based on false facts. Therefore—both appellants maintain—he could be deemed the perpetrator of the offense of malfeasance in office, provided for and punishable under Article 357 of the Código Penal. Given the similarity between the claims raised, they will be resolved jointly to avoid unnecessary repetition.

In Considerando II of the judgment under review—to the extent relevant here—the criminal court notes that the charges did not concretely and specifically establish the subjective element of the offense, namely criminal intent, with respect to the convergence of intent or common plan among the defendants to have the mining concession unlawfully granted to Industrias Infinito S.A.; and that an examination of the evidence, specifically the circumstantial evidence, does not establish the existence of intentional conduct (cf. Judgment, pp. 128 to 135).

Pages 135 to 144 of the Judgment set forth a general examination of the liability of all the accused, according to which their conduct does not satisfy the statutory definition of the offense of malfeasance in office attributed to them, due to the absence of criminal intent. The fact that Decreto Ejecutivo N° 34801-MINAE was annulled by the Tribunal Contencioso Administrativo (through decision N° 4399-2010 at 10:40 hours on December 14, 2010, which was subsequently affirmed by decision N° 1469 of the Sala Primera de la Corte Suprema de Justicia at 9:00 hours on November 30, 2011) does not mean that the officials involved in issuing it knowingly and intentionally decided contrary to law or on the basis of false facts:

“It should be noted that it cannot be ruled out that the violations of the Legal System identified and brought to light by the Tribunal Contencioso Administrativo resulted from a deficiency, lack of knowledge, or simple error on the part of the defendants; however, for the purposes relevant here, it was not established that they resulted from deliberate conduct by the accused. To consider that the mere declaration of nullity of the decisions by the Tribunal Contencioso Administrativo is sufficient to deem the conduct of a public official to constitute malfeasance in office would, in practice, lead to the disappearance of disciplinary liability and would consequently leave judges or administrative officials who issue decisions contrary to law in the perpetual position of being subjected to the disgrace of criminal proceedings. This is because there is an undeniable margin of judgment when applying the law to a specific case, defining its scope, giving it meaning, and interpreting what it provides for cases generally.

In this regard, it must always be borne in mind that the Legal System is a systematic whole, while also recognizing that it is a system which, according to the most highly regarded authors, can never be considered definitive and complete—which is logical—but must always be regarded as susceptible to modification and renewed harmonization whenever new principles for addressing new problems must be incorporated into it. The task of the interpreter, therefore, is not and will not be easy. All apparent contradictions arising from the solutions to different problems must progressively be overcome, and those solutions must be harmonized within a constantly changing system. Therefore—it bears repeating—the work of interpretation is an activity requiring incisive and sophisticated analysis...” (sic, Judgment, pp. 137 to 138).

Pages 144 to 146 provide certain general explanations regarding the examination and assessment of circumstantial evidence (prueba indiciaria).

With respect to the defendant [Nombre 001], on pages 146 to 174 of the judgment, the criminal court explains the reasons why it considers that the two acts charged against him do not satisfy the statutory definition of an offense: (a) the act concerning Decreto Ejecutivo N° R-217-2008-MINAE (with respect to which the effect provided for in Article 466 bis of the Código Procesal Penal applied because the challenged judgment reiterated the acquittal ordered in judgment N° 32-2015); and (b) the act concerning Decreto Ejecutivo N° 34801, which declared the Proyecto Minero Crucitas to be in the public interest and of national convenience and is the subject of the present review. Regarding the latter, the core of the act charged by the Ministerio reads as follows:

“30. Thus, the accomplice [Nombre 006], who at that time served as Secretary General of the Secretaría Técnica Nacional Ambiental, for the purpose of favoring the developer’s interests and assisting co-defendant [Nombre 001], and knowing that the issuance of executive decrees declaring national convenience, as well as the required social-benefit/socio-environmental-cost balance underlying them, falls within the exclusive authority of the Executive Branch pursuant to the exception provided for in Articles 19(b) and 34 of the Ley Forestal, assumed functions that did not belong to her and issued official letter number SG-ASA-259-2008 of October 10, 2008, addressed to Mr. [Nombre 019]. She stated that the balance obtained through the appropriate instruments made it possible to establish that the socioeconomic benefits exceeded the environmental costs, although those instruments were not applied in issuing the executive decree declaring national convenience.

31. Thus, the accused [Nombre 001], in his capacity as Minister of Environment, Energy and Telecommunications and acting as the Executive Branch, even though the project did not meet the legal conditions to be declared of national convenience, and with the assistance provided by the accomplice [Nombre 006] through her execution of official letter number SG-ASA-259-2008, issued Decreto Ejecutivo N° 34801-MINAET, dated October 3, 2008, published in La Gaceta N° 201 of October 17, 2008, thereby declaring the Proyecto Minero Crucitas to be of national convenience, in contravention of Articles 3(m), 19(b), and 34 of the Ley Forestal, as well as Article 361 of the Ley General de Administración Pública” (sic, Judgment, pp. 11 to 12).

Whereas the private prosecution (querella) filed by the Procuraduría General de la República describes it as follows:

“45.-As a result of the request made by the Director of Área de Conservación Arenal- Huetar Norte, the defendant [Nombre 006], acting in her capacity as Secretary General of SETENA, for the purpose of favoring the interests of the company Minera industrias Infinito S.A. and assisting her co-defendant [Nombre 001], with full knowledge that Decrees of National Convenience (Decretos de Conveniencia Nacional) fall within the exclusive authority of the Executive Branch, pursuant to the exception provided for in article 19 subsection m) and 34 of the Ley Forestal, assumed powers that did not belong to her and issued official letter SG- ASA-259-2008 dated 10 de octubre de 2008, addressed to [Nombre 019], in which she asserted that the balance obtained through the appropriate instruments made it possible to establish that the socioeconomic benefits were greater than the environmental costs. The defendant [Nombre 006] made this assertion without any basis whatsoever, because there is no evidence that the instruments to which she referred in the aforementioned official letter were applied for the issuance of the decree of national convenience.

  1. 46Thus, with the assistance of the accused [Nombre 006] through her signing of official letter SG-ASA-259-2008, the then Minister of the Environment and now accused, [Nombre 001], unlawfully issued, jointly with the President of the Republic at that time, Oscar Arias Sánchez, Decreto Ejecutivo N° 34801-MINAET, published in La Gaceta N° 201 on 17 de octubre del 2008, declaring the Proyecto Minero Crucitas to be in the public interest and of national convenience. This Decree violates the legal framework governing the matter with respect to the procedure, grounds, and statement of reasons, because the rules established in article 3 subsection m of Ley Forestal and article 2 of the Regulations to Ley 7575 concerning the requirements for a declaration of national convenience, as well as provision 6. 6 of the Código de Minería concerning a declaration of public utility, were flagrantly disregarded. Among the procedural violations—among other matters—was the failure to grant representative entities having either a general or corporate interest the periods established by law so that those civil-society organizations could express their views on the project; as to the statement of reasons, the declaration lacked a technical basis because no analysis was conducted of social and economic variables in the project area.” (sic, Judgment, p. 24).

Pages 153 through 174 specifically examine this aspect of the charges, developing the central thesis that:

“It is therefore not sufficient for an administrative decision objectively contrary to the law to be issued for the offense of prevarication (Prevaricato) to exist; rather, the perpetrator must act with knowledge that the decision being adopted is unlawful and with the intent to act with that knowledge. This must be proven and may neither be presumed nor established through mere legal fiction, as required by article 34 of the Código Penal. From that provision, it is clear that the perpetrator (sujeto activo) must know the factual circumstances described in the statutory definition of the offense (tipo penal)” (Judgment, p, 156).

The criminal court finds that several administrative bodies participated in issuing Decreto Ejecutivo N° 34801 and that several opinions were provided, including conflicting ones, but that no illegality, conflict with the legal system, or defect in the procedure, grounds, or statement of reasons was ever identified. Drafting the decree was entrusted to the Dirección Jurídica del Ministerio del ambiente, which is composed of several attorneys. The Oficina de Leyes y Decretos de la Casa Presidencial, also composed of expert attorneys and serving as a review mechanism for the correctness and legality of decrees before their publication, likewise did not detect the defects identified by the Tribunal Contencioso Administrativo. The criminal court therefore finds no evidence of the criminal intent (dolo) required for the offense of prevarication, but rather a decree rendered defective by errors in the administrative procedure or in the interpretation of its legal requirements, which it discusses in the following terms:

“Following that reasoning, given that the crime of malfeasance (Prevaricato) includes, as an objective element, that the decision adopted be contrary to the legal order (Ordenamiento Jurídico) and that the action be voluntary, the mere finding that rules were violated—in the manner and according to the detailed findings of the Administrative Litigation Court—is not sufficient to establish this offense, ‘because this would undoubtedly erase the line to which we referred in the opening recital of this judgment and would lead to the disappearance of disciplinary liability, normalizing criminal prosecution against public officials in every case in which the Administrative Litigation Court or an appellate court (in judicial cases) orders the annulment of an act or decision on the ground that it is contrary to law. Moreover, under this reasoning, it must be borne in mind—as the traditional feature of the concept of criminal intent (dolo)—that knowledge must exist at the time the offense is committed; consequently, that phenomenal process must actually be established in the criminal proceedings.

In the present case, there is no basis upon which it may validly and convincingly be established that the accused (imputado), [Nombre 001], in his capacity as Minister of the Environment, issued the Decree referred to herein with the awareness and intention of violating the legal order. This is essential—not tangential—because malfeasance is an intentional unlawful act, that is, one fundamentally requiring criminal intent, and its establishment requires proof that the perpetrator acted intentionally and with knowledge that, in deciding a matter, he was acting contrary to the law or on the basis of false facts. From the relevant portion transcribed from the decision of the Administrative Litigation Court, which constitutes the theory of both the prosecution and the private criminal complaint, this Court is able to establish only that the defendant herein, [Nombre 001], who was Minister of the Environment at the time, acting jointly with the President of the Republic, signed the National Interest Decree (Decreto de Conveniencia Nacional), which was ultimately annulled by the Administrative Litigation Court—nothing more.

The accusers’ attribution of liability in the present case is unsupported by direct evidence, and the circumstantial evidence (indicios) cited is insufficient to establish intentional conduct; moreover, the accusers’ classification of the issue of criminal intent reveals neither coherence nor sound legal reasoning. Accordingly, because criminal intent has been disproved in the conduct of the accused herein, [Nombre 001], the offense attributed to him cannot be established and, consequently, his conduct does not constitute a criminal offense (atípica). In any event, as we shall examine in detail, based on the evidence introduced at trial and the statement given by the accused, [Nombre 001], the conduct attributed to him does not even approach what may validly be regarded as malfeasant conduct. As a starting point, therefore, the accusers neither properly alleged nor proved beyond certainty intentional conduct involving criminal intent on the part of Mr. [Nombre 001].

To support what we have stated, it cannot be denied that issuing the National Interest Decree required weighing the interests at stake, without losing sight of the relationship that always exists between environmental impact and Human Rights, a matter we have already highlighted here. It is enough to note that environmental matters, because they involve a fundamental right, cut across the entire legal order and that, precisely for this reason, all decisions made entail a degree of complexity, since many laws and decrees are involved and several administrative agencies participate—some in purely technical matters and others in legal matters. This cannot be disregarded because of its importance to the resolution of this case, and we shall return to it below. It should also be noted that this National Interest Decree cannot be separated from the issue of the land-use change permit (permiso de cambio de uso de suelo) for the land owned by the company.

In this regard, Article 19(b) of Ley Forestal establishes an exception to the general protection afforded to forests where ‘national interest’ is involved; in such circumstances, the social benefits, which must exceed the socio-environmental costs, must be balanced against those costs. The provision certainly establishes broad regulation in terms of its wording and is quite difficult to understand, and it must therefore readily be acknowledged that its application is by no means an easy task. It is noted that the provision was challenged and that the Constitutional Chamber issued a ruling in judgment number 2006-17126. To paraphrase the Chamber, it held that, upon examination of the governing environmental principles, that provision, in relation to Article 34 of the same body of law, is not contrary to the right to a healthy and ecologically balanced environment, provided that it does not constitute authorization for public institutions to ‘legitimately’ harm the environment, nor an exceptional regime.

(Cf. Voto número 2006-17126 de la Sala Constitucional). According to that ruling, the possibility of land-use change (cambio de uso del suelo) is reserved exclusively for private forestland (patrimonio forestal privado). It is therefore clear that the provisions challenged before the constitutional jurisdiction do provide for the possibility of land-use change on private properties subject to restrictions because forest cover (cobertura boscosa) exists there. This is necessary because only in this manner can the construction of infrastructure works be permitted, since it would be unrealistic to contemplate mining activity without constructing the infrastructure necessary to carry out mineral extraction, such as roads, tailings ponds, guardhouses, and other facilities. Consequently, everything remains subject, of course, to the environmental regulations in force at the time. Thus, in pursuit of the general interest of the national community, both rights must be weighed and their exercise balanced in accordance with the principle of sustainable human development (desarrollo humano sostenible), understood as the need for a balanced interrelationship among the critical elements of economic development (tourism, investment, employment, infrastructure, sound public finances, and the tax system), social policy (education, health, and security), and environmental protection.

In this regard, because of its importance to the matter being decided, that ruling stated: ‘The United Nations has defined this development as the expansion of the options available to all persons in a society. It is a comprehensive concept because it places men and women at the center of development and includes the protection of opportunities in the lives of future generations and of the natural systems upon which life as a whole depends. Its fundamental purpose is to create an enabling environment in which everyone may enjoy long, healthy, and creative lives, since economic growth is also a means of achieving human development. What matters, therefore, is to permit the industrial and technological development of peoples, but in a manner that is tolerable in its use of the physical and social environment, for the purpose of achieving economic and social progress. The responsibility lies in balancing environmental protection, economic development, and private activities so as to justify State intervention.’ (Cf.

Voto 2006-17126 de la Sala Constitucional). Consistent with this and with our position that the analysis of the conduct alleged to constitute malfeasance must be situated in the historical context in which it occurred—because criminal intent, as knowledge, exists at the time the offense is committed—any other understanding would misconstrue deserved punishment as a corrective factor in criminal attribution. It must also be said that many of the errors arising from the criminal charges in this case are due to this distorted view of matters. It can readily be seen that, in the dilemma intuitively and tacitly posed from the outset and, as has become apparent over the course of the examination of the cases, there is an important difference between what should be understood as the ‘determination’ and the ‘attribution’ of criminal intent. Continuing with this point, it was then that the ‘balance’ required between environmental protection and economic development was weighed.

This is precisely the link or correspondence between the objectives declared in the National Development Plan mentioned by the accused, [Nombre 001], in his statement and verified by the Court. That National Development Plan, adopted by the government administration in which he served as Minister, shows that mining activity—generally, and not only the Crucitas project—was indeed considered important for generating employment and well-being in communities, and promoting it was therefore an objective of the highest importance. The accused acknowledged this when he testified, and it is evident that mining was not an obscure matter under that government. Only within this analytical framework can it be determined whether the conduct alleged against the accused herein and the purported accomplice, co-accused (coimputada) [Nombre 006], may be considered intentional and, consequently, legally constitutive of an offense, if we wish to approach the ideal of law as justice and thereby avoid the serious risk of shifting the center of gravity of the wrongful act from negligent or nonpunishable conduct to intentional conduct, while eliminating any possibility of imposing strict liability (responsabilidad objetiva) solely because he was the highest-ranking official of the Ministry of the Environment, within which the Decree was prepared.

During the adversarial proceedings, the accused, [Nombre 001], not only denied the charges but also addressed them specifically and extensively. Regarding the testimony of witness [Nombre 020], he notes that significant disagreements have long existed between them because of their differing political positions on matters that clearly affect the environment, such as oil extraction and mining: ‘before the elections of February two thousand six, my relationship with him was not good; I was Minister of Science and Technology, President of ICE and of RECOPE; relations were not good because, during the administration, I served on a special joint committee in the Legislative Assembly that sought to reform ICE. We had disagreements; he continued to have a certain rivalry with me; before the 2006 elections, we had no rivalry. As for the transition period, don Oscar Arias, statements about what Abel had been doing, many differences; that is why many Ministers did not meet; there are no regulations requiring meetings with former ministers.

I explained to them what the government intended to do in connection with the National Development Plan, Mideplan; I have here a copy of this plan, which was published by decree. First, it is not true that I went there to speak only about mining and oil. He was not pleased with the incoming government’s new vision. Telecommunications were transferred to the Ministry of Energy and Mines, which was renamed MINAET. The aim was for I.C.E. to have a single governing Minister. We did not discuss oil. Regarding that subject, I knew their position, which is why the two oil exploration concessions had been granted under the administration of Miguel Ángel Rodríguez.’” He was Vice Minister when the first concession was granted to Industrias Infinito; I already knew that the Abel Pacheco administration opposed all oil exploration and mining.” He also added: “After becoming Minister, he continued to display considerable animosity toward me, as shown by a headline in the Semanario Universidad stating that I am not an expert on climate change and that I represent us poorly.

Before this trial, I had not spoken with him. I participated in a forum where he was a speaker by videoconference, but we did not speak.” Continuing, the defendant [Name 001] made it clear that he did not personally participate in drafting Decree No. 34801-MINAET because this was an essentially legal task and because, from a technical standpoint, its preparation involved other administrative divisions of the Ministry. In this regard, he emphatically acknowledged that he knew all these officials, that they enjoyed his complete confidence, and that they were the ones whom he entrusted with drafting the Decree. He stated that important changes were made to the Ministry’s organizational structure once he assumed the position of Minister of the Environment. Specifically, he asserted that the Ministry was strengthened by creating Vice Ministries, which in turn assumed responsibility for specific areas, while the Minister would be responsible for coordinating public policies, particularly those that were then of interest to the government, had been publicly announced, and were defined in the corresponding National Development Plan.

That plan contemplated mining as an activity that would create jobs for the country, and it was therefore in the government’s interest to promote that activity. The following excerpt from his testimony at trial is noteworthy: “The new government’s vision was that the country had to seek sources of development; this was in the National Development Plan and in the political discussions, but everything had to be done in accordance with the law. Regarding mining, the new government did not view mining negatively, provided that everything was done in accordance with the law. Those who participated included the Minister’s Office, the Legal Advisory Department, and the Conservation Areas System; in other words, all offices participated in accordance with the law.” Mr. [Name 001] denies any interference whatsoever with SETENA. Regarding the drafting of documents, decrees, and other administrative acts, including the Decree declaring the Crucitas project to be in the national interest, he acknowledges that he did indeed issue instructions for it to be drafted because the Director of the Huetar Norte Conservation Area had requested it.

However, like everything submitted to the Minister’s Office for signature, it followed a rigorous process and passed through various offices. He emphasizes primarily that the Ministry of the Environment’s Legal Directorate was entrusted with drafting the Decree, noting that another of the changes made during his time at the Ministry was that this Directorate had formerly been the Legal Department. It also passed through the review of the attorney in the Minister’s Office, whose task was to review in advance everything received from the Legal Directorate. In addition, it had to be sent to the Presidential Office’s Laws and Decrees Department for review. On this matter, the defendant testified as follows: “In the case of the Crucitas mining concession, I had no involvement whatsoever with SETENA. As for the classification into two types of decrees, I had previously served as Minister; there is only one type: Executive Decrees, period.

There was a team that conducted reviews. I have a guide containing information on this subject; it is important, as it explains how this matter was handled. It is important to indicate that the Ministry was going to have four Vice Ministries, each headed by a Vice Minister—one for Energy, Communications, Water—and each coordinated its various areas. They were all under supervision—the Vice Ministers—and everything appears in the President’s appointment decision, since he appoints them. When a document reached me for signature, it first went through the Legal Department, the Legal Advisory Directorate, formerly called the Legal Department. All documents signed by the Minister, including those relating to the mining concession, went first through the Vice Ministry and then through the Legal Advisory Directorate, the Geology and Mines Directorate, SETENA, and SINAC. SINAC is very large; it has eleven areas, each with its own autonomy, as well as an Executive Director, and each area has a Director.

Six institutions within MINAE were involved in this matter and were thoroughly familiar with it. In addition, in my Office I had an attorney, Ana Luisa Leiva. She worked in the Office and reviewed everything the Minister was to sign, sometimes large quantities of documents. If there was something she did not consider appropriate, she returned it. Once it had passed through this entire procedure, the Minister signed it pursuant to a legal provision, because these are acts of the Executive Branch. Regarding the decision granting the concession, Ana Luisa obtained the signature, and it was returned to the Legal Advisory Directorate so that it could be sent to the Laws and Decrees Directorate, located in Zapote. From there, it went back to the Legal Advisory Directorate; it reached the Minister’s Office only once. Regarding the Decree declaring the project to be in the national interest, the answer concerning the administrative process is the same: it followed the same procedure.

No one called me to insist that I expedite the processing of these two documents. No one told me that I should not sign these documents. Moreover, they came with a formal note saying, ‘Mr. Minister, please sign,’ bearing the Vice Minister’s signature. When they reached me, I understood that everything was in order.” It can also be inferred from his testimony that when the Decree was submitted to him for signature, it bore the approval of the Head of the Legal Department, counsel [Name 018]. It was customary in processing this type of act to note, for validation by the head of the Legal Directorate, that the document submitted for signature had received “approval,” and the corresponding seal of that Directorate was affixed. On this particular point, the defendant said: “The request that the Decree declaring the project to be in the national interest be issued came from the Huetar Norte Conservation Area, which stated that it was necessary.

All of that went to the Legal Advisory Office. I did not participate in drafting it; I had complete confidence in them. It was formally sent to me, like everything I had to sign. There were always concessions involving telecommunications and water. I did not sign anything unless it bore the approval of the legal division, and its seal was even affixed. When I signed it, I did so with complete confidence.” At trial, it was confirmed that the case file in which the Executive Decree was processed does in fact bear the approval of the Head, counsel [Name 018], followed by the wording: “Please find attached for your corresponding signature...” In his testimony, he denies having met with representatives of Industrias Infinito and states that he never visited the Crucitas mining project. As for former President Oscar Arias, he asserts that Arias never pressured him regarding the concession and that, in general, no one pressured him.

Finally, in his testimony, the defendant mentions the existence of the Constitutional Chamber’s ruling validating the actions taken regarding this Decree declaring the project to be in the national interest, stating that the Chamber found everything to be in order. He also states that he finds it surprising that, in the Administrative Litigation proceeding, the Attorney General’s Office defended all the actions of the administrative officials concerning the mining concession granted to Industrias Infinito. The Court has reviewed the ruling. We see that, when addressing the balancing of the economic and social benefits for authorization of the land-use change, after Industrias Infinito submitted its application for a land-use change to the Huetar Norte Conservation Area, and before examining and assessing the issue, a declaration of national interest was requested. The judgment records that there had been discussion as to whether such a declaration was necessary, and it was not until September 24, 2008, through Official Letter No. 695-2008 SC, that the San Carlos-Los Chiles Subregion of SINAC’s Huetar Norte Conservation Area informed Industrias Infinito that a decree declaring the project to be in the national interest was indeed required before the land-use change application could be decided.

The point being made here is that this was not something that could be taken for granted as being clear. The discussions occurred precisely within the Conservation Area, the administrative division responsible for ensuring full compliance with forestry regulations, and, more specifically, with the involvement of the legal advisory office; it was not an undisputed issue. The request to convict the defendant [Name 001] was based on the contention that Executive Decree No. 34801-MINAET was founded on a false fact, specifically because the assessment balancing socioeconomic benefits against environmental costs had been omitted. To this it is added that the defendant herein was responsible for preparing the Decree for submission to the President; that the Decree fell within the framework of the National Development Plan, meaning that there was “political pressure” for the project to materialize; and that it was processed in a very short time, referring to the issuance of the Decree and SINAC’s granting of the tree-cutting permit (through Decision No. 244-2008-SCH).

Regarding this basis for seeking the conviction of the defendant herein, the first thing that stands out is that it does not clearly correspond to the premise of the charges as formally notified, since what is alleged there is that the Decree was issued even though the Crucitas mining project did not satisfy the legal requirements for being declared in the national interest, in violation of Articles 3(m), 19(b), and 34 of the Forestry Law. For greater clarity, it is important to know the content of Executive Decree No. 34801-MINAET, published in La Gaceta No. 201 on October 17, 2008, which expressly provides, insofar as relevant, that:

“VII. The Crucitas Project will bring several economic benefits to the community of San Carlos and the central government. These benefits include the following: i) The mine will operate for approximately 11 years (including construction, operation, and technical closure); this means that during that period there will be development in the communities near Crucitas and a need for labor; ii) The initial investment to build the Crucitas mine is approximately US$65.000.000. It is estimated that a large portion of that amount will be used to purchase professional services, pay contractors, and purchase materials and machinery, many of them acquired in the San Carlos area; iii) It is estimated that it will directly employ 253 people. In mining, it is estimated that for every direct employee, employment is created for 5 indirect employees; therefore, there will be 1.265 indirect employees; iv) The social commitments will seek to ensure that at least 75 % of employees are from the area near Crucitas; v) Payroll: The annual payroll for employees is estimated at US$4.132.859; vi) Local tax: The Mining Code establishes that mining companies must pay 2% of their gross profits to the community; therefore, the Municipalidad de San Carlos and the community within Crucitas’s area of influence would receive approximately US$1,441.158 annually for eight years (for a total of US$11.529.263); vii) A trust fund (fideicomiso) is maintained to develop social projects and support the activities of the Crucitas Project monitoring commission, which would receive the sum of US$364.063 annually; and viii) The Crucitas Project will pay taxes to the central government; annual income-tax payments are estimated at US$8.790.289, for a total of US$70.322.309 over the life of the mine.

VIII.-The construction and development of the Crucitas Project require the felling of trees (corta de árboles) on 191 Ha 7782,66 m2 of forested land, representing 19.93% of the forest existing on all the properties; the felling of trees on 66 Ha 9474,53m2 in agricultural-use areas without forest, representing 14% of the agricultural-use areas without forest existing on all the properties; and the felling of trees on 4Ha 1 751.38m2 containing forest plantations (plantaciones forestales), representing 12.33% of the forest plantations existing on all the properties. Among the forest species in the area are certain protected species subject to a logging ban (especies vedadas), pursuant to Constitutional Chamber Judgment No. 2486, issued at 10 hours 54 minutes on 8 March 2002, and Executive Decree No. 25700 of 15 November 1996. IX. As compensation for the land-use change (cambio de uso), Industrias Infinito, S.A. proposed the following compensation measures: i) Support for the purchase of land for conservation in the amount of two hundred fifty thousand dollars; ii) The planting of 49.8 trees for every tree that must be felled; and iii) The creation and conservation of a biological corridor within its properties. Por tanto, THEY HEREBY DECREE:

DECLARATION OF PUBLIC INTEREST AND NATIONAL BENEFIT OF THE CRUCITAS MINING PROJECT Article 1.-The Crucitas Mining Project, developed by Industrias Infinito, S.A., is hereby declared to be of public interest and national benefit.

Article 2.-By virtue of this declaration, the developer, upon prior authorization from the appropriate office of the Sistema Nacional de Áreas de Conservación, may proceed with the felling of trees (including species subject to a logging ban) and the development of infrastructure works in protected areas (áreas de protección), as indicated in the project. (...)”.

With respect to the alleged political pressure, none of the evidence received during the adversarial proceedings shows that the accused herein or any senior official exerted improper pressure regarding the processing of the mining concession (concesión minera) as a unified whole, at any stage or before any agency, and no public official reported having received any form of improper pressure to rule in favor of Industrias Infinito; this argument is therefore speculative and wholly unsupported. As for the fact that the government’s intended promotion of mining activity was included in the Plan Nacional de Desarrollo, this was not concealed; it was handled with complete transparency and, in any event, the Mining Code regarded mining activity as being in the national interest, so the purposes declared in the law had to be implemented in some manner by public-policy officials. Regarding the short period mentioned by the prosecutor, that assertion reflects a significant bias because it disregards the fact that Industrias Infinito had begun the procedures to obtain the mining concession many years earlier and had experienced advances and setbacks due to circumstances that arose over time.

By way of example, given its proximity to the publication of the Decree, official letter number SG-ASA-259-2008, dated 10 October 2008, indicates that SETENA informed the Departamento de Auditoría y Seguimiento Ambiental that the assessment to determine the balance between the project’s environmental cost and its socioeconomic benefits had been conducted before SETENA over a period of three years. From a reading of the recitals (considerandos) listed in the Decree at issue, the Court cannot infer anything that could be characterized as false. On the contrary, what can be seen is that, when the Administration—specifically, the accused in his capacity as Minister and the President of the Republic—issued the Decree, they clearly understood that the project would indeed affect the environment, that is, that it would entail environmental costs; however, according to the information presented by the administrative agencies responsible for evaluating these technical and legal matters, it would also generate employment in the Crucitas area and revenue for the State and the Municipality, among other benefits.

It must not be overlooked here that environmental law, understood as a complex system and as a body of national and international legal rules and principles that regulate and guide relations between human beings and their natural and urban surroundings, also seeks to achieve a balance that permits human needs to be met through social, productive, and cultural processes while safeguarding the integrity and conservation of biodiversity. For this reason, the environmental-management bodies were involved throughout the process that ultimately produced the Benefit Decree, and the various factors and assessment results were evaluated: first before the Dirección de Geología y Minas for the granting of both the exploration concession and, subsequently, the exploitation concession; and later before SETENA to obtain environmental approval (viabilidad ambiental). The Dirección Jurídica del MINAET, the Departamento de Leyes y Decretos de Casa Presidencial, and, of course, the attorney from the Minister’s Office, [Nombre 001], participated in reviewing the actions and the Decree; only when it was deemed ready for signature and publication did they proceed accordingly.

There was no intentional conduct aimed at violating the legal system (Ordenamiento Jurídico). Notwithstanding the Administrative Litigation Court’s ruling regarding the defects identified in the National Benefit Decree, it is an entirely different matter to maintain in these proceedings that the accused herein, [Nombre 001], acted with criminal intent—that is, knowingly and willingly. The Administrative Litigation Court has already defined how the study mentioned in the Ley Forestal was required to be prepared. For purposes of the matter we have been called upon to determine, however, the Decree at least identifies and explains what were then regarded as the benefits the project would generate, the environmental costs—which do not necessarily constitute environmental damage—and the manner in which they would be compensated to some extent. From a criminal-law perspective, therefore, this cannot constitute the offense of unlawful judicial or administrative decision-making (Prevaricato), because determining its scope required an interpretation of the Ley Forestal, which does not clearly define the issue.

The officials thus had some latitude in interpreting the law, which precludes correspondence with the statutory elements of the offense (adecuación típica). It is also worth noting that, under the principles governing sound argumentation, when a conclusion follows from the premises, obtaining a reliable conclusion requires bearing in mind that an argument is not itself an assertion, but rather a set or series of assertions characterized by the fact that some follow from others—an attempt to support certain opinions with reasons; to make an argument means to offer a set of reasons or evidence in support of a conclusion. Thus, the premises or conclusions themselves may be true or false, but that does not affect how the argument is classified. An argument may be valid or invalid, sound or unsound, but it cannot be true or false, a quality that can be attributed only to premises or conclusions.

It will be valid or sound if the premises effectively support the conclusion and invalid or unsound otherwise. This is how this Criminal Court assesses the issuance of the Decree; only in this manner is it possible to determine whether the conduct attributed to the accused, [Nombre 001], falls within the criminal provision under which he has been charged.

From the contents of the proceedings, the evidence, and the other evidentiary materials analyzed, throughout this matter concerning the mining concession granted to Industrias Infinito, we see that several administrative bodies intervened, several opinions were issued—including contradictory opinions among the legal departments of the Ministry of Environment itself—a number of attorneys participated during the administrative proceeding, and, moreover, the Constitutional Chamber ruled on certain issues concerning the mining concession in question. It is appropriate to bear in mind that the Constitutional Chamber, in the decision mentioned by the defendant (imputado) herein, was also clear in stating that: “it is not necessary for the decree itself to expressly set forth the entire assessment conducted, the instruments applied, the methodology used, or the scores obtained and assigned under each item; these are requirements that must be fulfilled at the administrative level, but it is not necessary to transcribe the entire assessment into the body of the decree, because, for purposes of stating the grounds for the regulatory instrument, it is sufficient to refer to the completion of the balance-assessment procedure and explain the costs and the benefits to be obtained—that is, for the decree to demonstrate through specific and exact data that the assessment was indeed conducted...” (See Constitutional Chamber judgment 4399-2010).

This was stated by the Republic’s highest Court; how, then, can it be maintained that the accused (imputado) [Nombre 001] acted willfully when signing the Decree that is alleged to have lacked the “assessment and measurement instrument”? What has been stated truly requires no further comment, since it is evident that, as presented to him for signature, the Decree objectively satisfied what the accused could understand to be valid, proper, and lawful; and regarding what the Chamber specifically noted, we also find that the notice of charges does not proceed along those lines. Although the issue is in fact complex to explain here, consideration must be given to the discussions that have taken place and that are relevant here concerning the conception of criminal law as a social technology, particularly the debate between Jürgen Habermas and Niklas Luhmann, which gave rise to intense controversy in which several internationally renowned authors have taken sides.

Ultimately, it may be concluded that, within the framework of a social technology, truth serves to maintain the existing order, functioning as a means of reducing the complexity of the surrounding environment and as a guarantee of invariability, providing certainty on the basis of an empirical generalization of the recognition afforded to a particular proposition. There is therefore no possibility whatsoever of considering the conduct of the defendant [Nombre 001] willful, because, amid that sea of regulations, the accused persons made their assessments and interpretations, regardless of the fact that the Administrative Litigation Court—acting from its vantage point as a reviewer of legality—subsequently ruled that those actions, decisions, and decrees were contrary to law. As a corollary to the foregoing, this criminal proceeding did not establish that the defendants acted deliberately; the cognitive element of criminal intent required for the offense of prevarication (Prevaricato) is absent, as is any possibility of discerning the volitional element of intending to issue a decision contrary to the law and to the duties of public office (Función Pública).

The accusers were required to prove actual, or at least potential, knowledge of the objective elements of the criminal offense of prevarication, as well as the intent to commit it with that knowledge; those elements are not present in the case submitted for review by this panel of the Court. It cannot be denied or ruled out that the violations of the legal system (Ordenamiento Jurídico) identified and brought to light by the Administrative Litigation Court may have resulted from shortcomings, lack of knowledge, or simple error on the part of the defendants. For present purposes, however, it was not established that they resulted from deliberate conduct by the accused persons, since there is an undeniable margin of judgment when applying the law to a specific case, defining its scope, giving it meaning, and interpreting what it establishes for cases generally. In this regard, it must always be borne in mind that the legal system is a systematic whole, but also that it is a system which, according to the most highly regarded authors, can never be considered definitive and complete—which is logical—but must always be regarded as susceptible to modification and renewed harmonization whenever it becomes necessary to incorporate new principles for addressing new problems.

For the reasons stated, the accused [Nombre 001] is acquitted of the two offenses of prevarication that had been attributed to him as having been committed to the detriment of the Duties of Public Office.» (sic, Judgment, pp. 160 to 174).

The criminal court then specifically examines the case of co-defendants [Nombre 002], [Nombre 003], [Nombre 004], and [Nombre 005], on pages 175 to 188; the case of defendant [Nombre 009], on pages 216 to 219 of the judgment; and the case of accused [Nombre 006], on pages 219 to 222. Regarding the latter, this Court of Appeal notes that the charging instruments alleged that Ms. [Nombre 006] had acted as an accomplice (cómplice) of defendant [Nombre 001] with respect to the offense related to the issuance of Decreto Ejecutivo 34801-MINAE. Nevertheless, the Public Prosecutor’s Office itself requested that she be acquitted, a request granted by the criminal court, which stated that “the investigation produced no testimonial or documentary evidence establishing, even as a matter of suspicion, any connection between [Nombre 001] and [Nombre 006]; it is therefore impossible to attribute to the latter any involvement as an accomplice in the unlawful acts attributed to [Nombre 001]” (see Judgment, pp. 219 to 222).

Accordingly, the criminal court concludes that the following are acquitted of all punishment and liability: a) defendant [Nombre 001], regarding the acts charged by the prosecution and the private complainant and classified as constituting two offenses of prevarication to the detriment of the duties of public office; b) defendants [Nombre 006] and [Nombre 009], regarding the acts charged against them as accomplices of [Nombre 001] in the commission of the offense of prevarication; and c) defendants [Nombre 002], [Nombre 003], [Nombre 004], and [Nombre 005], regarding the acts charged as constituting an offense of prevarication to the detriment of the duties of public office.

The appellants, for their part, maintain that the evidence examined yields circumstantial evidence (indicios) permitting the conclusion that defendant [Nombre 001] did act willfully and, furthermore, that the criminal court arbitrarily excluded testimonial evidence that could have been essential to proving criminal intent, specifically referring to witnesses [Nombre 010], [Nombre 011], and [Nombre 012], who declined to testify after the criminal court, in light of the position taken by defense counsel for the defendants, determined that they were suspect witnesses (testigos sospechosos). Both appellants argue that the existence of possible self-incrimination can be determined only from what the witnesses testify to and not in advance of their testimony. They therefore maintain that the criminal court prejudged the matter by considering them suspect witnesses before they testified at trial, despite the absence of any basis for the trial court to conclude that questioning those witnesses might incriminate them.

These objections are without merit. In the view of this Criminal Judgment Court of Appeal, there is no reason to consider that grounds for suspecting a person’s participation in the commission of a particular criminal act must necessarily arise from what that person states as a witness at trial. Such grounds for suspicion may also derive from other sources, as occurred in the present case, given that witnesses [Nombre 010], [Nombre 011], and [Nombre 012] chose to decline to testify as suspect witnesses because they had been officials who participated in and signed some of the acts or decisions described by the Public Prosecutor’s Office in the charging instrument, which were declared unlawful by the Administrative Litigation Court (see Judgment, pp. 100 to 101). The court’s decision was therefore not arbitrary but consistent with the guidelines established by the cited constitutional case law.

Article 204, first paragraph, of the Criminal Procedure Code clearly provides that “A witness shall not be required to testify concerning facts that could expose the witness to criminal liability,” and the Constitutional Chamber’s case law cautions that “a suspect witness may decline to state anything that could expose him or her to criminal liability, and the judge hearing the case must assess this circumstance in the specific case, advise the witness of the consequences of his or her statements, and inform the witness of the right to remain silent. Testimony received in contravention of the foregoing shall have no effect and shall be absolutely null and void because it violates the principles comprising due process. Moreover, nothing prevents the judge from allowing the suspect witness to obtain the advice of counsel so that the witness may understand which statements could expose him or her to criminal liability.” (Sala Constitucional N° 5630 de las 16:06 horas del 28 de setiembre de 1994, reiterated in N° 8733 de las 8:30 horas del 13 de agosto de 2004).

Additionally, none of these three witnesses would have been dispositive of the case, since none was offered to prove that defendant [Nombre 001] acted willfully when signing Decreto Ejecutivo 34801-MINAE. As to the examination and assessment of the witnesses who did testify at trial—particularly the testimony of [Nombre 014], [Nombre 018], and [Nombre 015]—and of the documentary evidence, the contention that they provide circumstantial evidence establishing with certainty that the accused acted willfully is likewise without merit. This issue was addressed extensively by the trial court, which noted that the circumstantial evidence advanced by the accusers was not specific and lacked sufficient probative value to establish with certainty that defendant [Nombre 001] acted with the knowledge and intent required for the criminal offense of prevarication. He was not the person who drafted Decreto Ejecutivo 34801-MINAE—the text was drafted by a legal department—and he was not warned that the instrument might be unlawful; rather, he signed it because it bore the approval of the Ministry’s legal department.

On page 187 of the judgment, the criminal court notes that, during the administrative litigation proceeding, the Office of the Attorney General of the Republic instead defended the legality of the decisions issued by the Public Administration, demonstrating that determining whether the decrees identified in the charging instrument—particularly 34801-MINAE—complied with the Costa Rican legal system was not a straightforward matter.

In accordance with the foregoing, no defect is apparent that would render ineffective the judgment acquitting defendant [Nombre 001] of an offense of prevarication in connection with the issuance of Decreto Ejecutivo 34801-MINAE. The appeals from the judgment filed by the Public Prosecutor’s Office and the Office of the Attorney General of the Republic are therefore denied.

POR TANTO:

The appeals from the judgment filed by the Public Prosecutor’s Office and the Office of the Attorney General of the Republic are denied. Resolución: 2025-0017 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las nueve horas del ocho de enero de dos mil veinticinco.

RECURSO DE APELACIÓN DE SENTENCIA interpuesto en la presente causa seguida contra [Nombre 001], [...]; [Nombre 002], [...]; [Nombre 003], [...]; [Nombre 004], [...]; [Nombre 005], [...]; [Nombre 006], [...]; y [Nombre 009], [...]; por el delito de PREVARICATO, en perjuicio de LOS DEBERES DE LA FUNCIÓN PÚBLICA. Intervienen en la decisión los jueces Jorge Luis Arce Víquez, Manuel Gómez Delgado y Ana Isabel Solís Zamora. Se apersonaron en esta sede el licenciado Christian Hugo Barrero Godínez, Procurador de la Ética Pública; el licenciado Carlos Manuel Jiménez Robleto, fiscal del Ministerio Público; y el licenciado José Miguel Villalobos Umaña, defensor particular.

RESULTANDO:

1°.– Que mediante sentencia número 876-2023 de las trece horas con treinta minutos del día veinte de noviembre de dos mil veintitrés, el Tribunal Penal del Segundo Circuito Judicial de San José, resolvió: «POR TANTO: Conforme lo expuesto y artículos 39 y 41 de la Constitución Política, 8 de la Convención Americana sobre Derechos Humanos; 1, 30, 47, 69, 71 y el 357 del Código Penal; 1, 141 al 144, 324, 360, 361, 364 al 366 del Código Procesal Penal; por unanimidad este Tribunal resuelve: Se absuelve de toda pena y responsabilidad al encartado [Nombre 008] por los hechos acusados y querellados, calificados como constitutivos de dos delitos de PREVARICATO, que en perjuicio de LOS DEBERES DE LA FUNCIÓN PÚBLICA se le venía atribuyendo. Además, se absuelve de toda pena y responsabilidad a las imputadas [Nombre 006] Y A [Nombre 009], por los hechos acusados en calidad de CÓMPLICES para la comisión del delito de PREVARICATO, como cometidos en daño de los DEBERES DE LA FUNCIÓN PÚBLICA. Finalmente, se absuelve de toda pena y responsabilidad a los imputados [Nombre 002], [Nombre 003], [Nombre 004] Y [Nombre 005], por los hechos acusados y querellados, calificados como configurativos de un delito de PREVARICATO, como cometido en daño de LOS DEBERES DE LA FUNCIÓN PÚBLICA. Los gastos del proceso penal son a cargo del Estado. Se ordena el cese de cualquier medida cautelar que con ocasión de la presente causa se hubiere decretado en contra de los aquí imputados. Para la lectura integral de la sentencia se fija el próximo treinta de noviembre a las quince y treinta horas. 2°.– Que contra el anterior pronunciamiento interpusieron sendos recursos de apelación de sentencia el licenciado Christian Barrero Godínez, Procurador de la Ética Pública; y el licenciado Carlos Manuel Jiménez Robleto, fiscal del Ministerio Público. A solicitud de la defensa del imputado [Nombre 001], se realizó una vista a las 9:30 horas del 30 de setiembre de 2024.

3°.– Que verificada la deliberación respectiva, de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó todas las cuestiones formuladas en el recurso de apelación.

4°.– Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el juez de Apelación de Sentencia Penal Arce Víquez; y

CONSIDERANDO:

I.Antecedentes. Para una mejor comprensión de las cuestiones a resolver, resulta necesario hacer un resumen de los antecedentes del caso. El Tribunal Penal del Segundo Circuito Judicial de San José, Goicoechea, dictó la sentencia N° 32-2015 de las 10:00 horas del 28 de enero de 2015, que dispuso:

«POR TANTO De conformidad con los artículos 39, 41, 140, 146 de La Constitución Política, artículos 1, 9, 37 a 41, 180 a 184, 324 a 367, 376 al 379 del Código Procesal Penal, 1, 57, 58, 59 a 63, 71, 74, 357, 365 del Código Penal, 3 y 84 del Código de Minería, 164, 187, 188, 189, 361 de la Ley General de la Administración Pública, 6, 17, 22 de la Ley Orgánica del Ambiente, 3 inciso m, 19, 34 de la Ley Forestal, 2 del Reglamento a la Ley Forestal, por unanimidad, se declara a [Nombre 001] autor responsable de UN delito de PREVARICATO por el Decreto Ejecutivo 34801-MINAS, en perjuicio de la LOS DEBERES DE LA FUNCIÓN PÚBLICA y en tal concepto se le impone la pena de TRES DE PRISIÓN, pena que deberán descontar, previo abono de la preventiva cumplida, en el lugar y forma que determinen los respectivos reglamentos penitenciarios. Se le impone a [Nombre 001] una INHABILITACIÓN de TRES AÑOS para el ejercicio de cargos públicos. Se absuelve de toda pena y responsabilidad a [Nombre 001], [Nombre 006], [Nombre 009], [Nombre 002], [Nombre 003], [Nombre 004] y [Nombre 005] de un delito de Prevaricato. Por calificar para ello a [Nombre 001] se le concede el beneficio de ejecución condicional de la pena por el plazo de CINCO años, lapso durante el cual no deberá cometer delito doloso sancionado con pena de prisión superior a seis meses pues, si así lo hace, se le revocará el beneficio aquí concedido y deberá descontar efectivamente la pena impuesta. Firme el fallo, inscríbase en el Registro Judicial de Delincuentes y comuníquese al Instituto Nacional de Criminología y al Juzgado de Ejecución Penal. Notifíquese mediante lectura. Hugo Porter Aguilar. Mercedes Muñoz Campos. Sergio Quesada Carranza. Jueces» (sic).

Ese mismo tribunal, mediante resolución de las 13:05 horas del 19 de marzo de 2015, adicionó la sentencia N° 32-2015 y resolvió:

«POR TANTO Así pues de conformidad con lo establecido en los numerales 15 y 147 del Código Procesal Penal se adiciona la sentencia de las diez horas del veintiocho de enero del año dos mil quince, para que en las páginas 182, 190 y 217 del fallo en cuestión en lugar de la palabra “peculado” se lea “prevaricato”. Se rechaza la pretensión de aclaración y adición de la defensa del acusado [Nombre 001]. Notifíquese Hugo Porter Aguilar - Mercedes Muñoz Campos - Sergio Quesada Carranza» (sic).

Contra la sentencia N° 32-2015 de las 10:00 horas del 28 de enero de 2015 interpusieron sendos recursos de apelación de sentencia del imputado [Nombre 001]; su defensor particular, el licenciado Laureano Castro Sancho; la licenciada Natalia Rojas Méndez (fiscal del Ministerio Público); y el licenciado Ronald Víquez Solís (en representación de la Procuraduría General de la República). El Tribunal de Apelación de Sentencia Penal, mediante resolución N° 2015-1539 de las 13:30 horas del 19 de noviembre de 2015, dispuso:

«POR TANTO: Se declaran admisibles los recursos interpuestos. Se acogen totalmente las apelaciones incoadas por el licenciado Luis Diego Hernández Araya y la licenciada Natalia Rojas Méndez, como fiscales del Ministerio Público y por el licenciado Ronald Víquez en representación de la Procuraduría General de la República y parcialmente las presentadas por el licenciado Laureano Castro Sancho como defensor de [Nombre 001] y por este imputado a título personal. En consecuencia, se rechaza la excepción de cosa juzgada constitucional y se anula integralmente la sentencia y el debate que le precedió, ordenándose el reenvío ante una nueva integración del órgano de instancia para que resuelva lo que en Derecho proceda, debiéndose respetar el principio de prohibición de reforma en perjuicio solo en cuanto a los hechos por los que recayó la condena contra [Nombre 001], aquí anulada y el desistimiento tácito de la acción penal efectuado por la Procuraduría General de la República respecto a dos imputadas otrora absueltas, porque dicha entidad no impugnó. Por innecesario, se omite pronunciamiento sobre la falta de condena en costas de las absolutorias. Tome nota el Tribunal de instancia de lo indicado en el considerando VII. NOTIFÍQUESE. Rosaura Chinchilla Calderón - Joe Campos Bonilla - Lilliana García Vargas - Juezas y Juez» (sic).

Con estos antecedentes es que el Tribunal Penal del Segundo Circuito Judicial de San José dictó la sentencia N° 876-2023 de las 13:30 horas del 20 de noviembre de 2023 –cuya parte dispositiva se describe en el Resultando 1° de la presente resolución–, que es objeto de los dos recursos de apelación de sentencia que nos ocupan, que han sido interpuestos por el Ministerio Público y la Procuraduría General de la República.

En cuanto a la admisibilidad formal de esos dos recursos, este Tribunal de Apelación de Sentencia, mediante resolución N° 1289 de las 14:30 horas del 6 de agosto de 2024, resolvió:

«Se admiten parcialmente los recursos de apelación interpuestos por el Ministerio Público, y la Procuraduría General de la República, únicamente en cuanto la sentencia N° 876-2023 dispuso absolver al imputado [Nombre 001] por el Decreto Ejecutivo N° 34801-MINAET de las 13:00 horas del 13 de octubre de 2008, publicado en La Gaceta N° 201 del 17 de octubre del 2008, que declaró de interés público y conveniencia nacional el Proyecto Minero Crucitas. Con fundamento en el artículo 466 bis del Código Procesal Penal, no son admisibles los reclamos dirigidos en contra la sentencia N° 876-2023, en cuanto esta reitera la absolución de los imputados [Nombre 009], [Nombre 006], [Nombre 004], [Nombre 005], [Nombre 002] y [Nombre 003] por los hechos acusados en su contra y en cuanto reitera la absolución del imputado [Nombre 001] por uno de los delitos de prevaricato acusados en su contra (el referido al Decreto Ejecutivo N° R-217-2008-MINAE)...»

II. RECURSO DEL MINISTERIO PÚBLICO

El licenciado Carlos Manuel Jiménez Robleto, fiscal del Ministerio Público ha interpuesto recurso de apelación en contra de la sentencia que el tribunal penal dictó en juicio de reenvío, N° 876-2023 de las 13:30 horas del 20 de noviembre de 2023. El recurrente sostiene que, en vista de que esta segunda sentencia reiteró, por una parte, la absolución de los imputados [Nombre 004], [Nombre 005], [Nombre 002] y [Nombre 003] por hechos acusados en contra de ellos y, por otra parte, también reiteró la absolución del imputado [Nombre 001] por uno de los dos delitos de prevaricato acusados su contra (el referido al dictado del Decreto Ejecutivo N° R-217-2008-MINAE de las 15:00 horas del 21 de abril de 2008), en este caso no es de aplicación la reforma introducida al artículo 466 bis del Código Procesal Penal (en adelante CPP) por el artículo único de la Ley N° 10200 de 5 de mayo de 2022, en el sentido de que el Ministerio Público, el querellante y el actor civil no podrán formular recurso de apelación contra la sentencia del tribunal de juicio que se produzca en juicio de reenvío que reitere la absolución de la persona imputada dispuesta en un juicio anterior.

Esto así, alega, por la tesis seguida por la Sala Tercera en cuanto a la irretroactividad de la ley procesal. Hace notar que la sentencia absolutoria anterior (N° 32-2015 de las 10:00 horas del 28 de enero de 2015), se dictó mucho antes de la indicada reforma al artículo 466 bis CPP. El fiscal incluye en su recurso extensas citas de un voto salvado del magistrado Salazar Alvarado en el voto de la Sala Constitucional N° 2023-8843, en el sentido de que el principio de aplicación retroactiva de la norma penal más favorable se refiere únicamente a la ley sustantiva (no a la ley de naturaleza procesal). En igual sentido, también hace citas de resoluciones de la Sala Tercera de la Corte Suprema de Justicia (N° 1993-416 de las 10:50 horas del 30 de setiembre de 1993; N° 2002-883 de las 13:40 horas del 12 de setiembre de 2002; N° 2004-115 de las 10:10 horas del 20 de febrero de 2004; N° 2005-1422 de las 10:15 horas del 7 de diciembre de 2005; y N° 2022-680 de las 10:24 horas del 24 de junio de 2022).

Agrega que en esta causa no ha operado el llamado principio de doble conformidad previsto en el artículo 466 bis CPP, porque según el principio tempus regit actum (locución latina que en español significa "el tiempo rige el acto") la norma a aplicar sería aquella que se encontraba vigente al momento en que el hecho juzgado se produjo. Concluye, entonces, que la reforma introducida al artículo 466 bis CPP no es aplicable, porque se trata de una norma de naturaleza claramente procesal y la primera absolutoria se dictó el 28 de enero de 2015, mucho antes de la reforma legal del año 2022. Hace notar que su recurso se presenta dentro del plazo de 30 días previsto en el procedimiento para asuntos de tramitación compleja, en los artículos 378 inciso e) y 460 del CPP. El fiscal Jiménez Robleto indica que se ha causado un agravio al Ministerio Público al absolver de toda pena y responsabilidad a los imputados [Nombre 001], [Nombre 004], [Nombre 005], [Nombre 002] y [Nombre 003], por lo que solicita que se anule la sentencia y se ordene un juicio de reenvío para su nueva sustanciación.

Es necesario tener presente, como se adelantó en el Considerando I de la presente resolución, que este Tribunal de Apelación de Sentencia, mediante resolución N° 1289 de las 14:30 horas del 6 de agosto de 2024, resolvió admitir parcialmente la apelación interpuesta por el Ministerio Público, únicamente en cuanto la sentencia N° 876-2023 dispuso absolver al imputado [Nombre 001] por el Decreto Ejecutivo N° 34801-MINAE de las 13:00 horas del 13 de octubre de 2008, publicado en La Gaceta N° 201 del 17 de octubre del 2008, que declaró de interés público y conveniencia nacional el Proyecto Minero Crucitas. Además, con fundamento en el artículo 466 bis del Código Procesal Penal, se declararon inadmisibles los reclamos dirigidos en contra la sentencia N° 876-2023, en cuanto esta reitera la absolución de los imputados [Nombre 009], [Nombre 006], [Nombre 004], [Nombre 005], [Nombre 002] y [Nombre 003] por los hechos acusados en su contra y en cuanto reitera la absolución del imputado [Nombre 001] por uno de los delitos de prevaricato acusados en su contra (el referido al Decreto Ejecutivo N° R-217-2008-MINAE). Por lo anterior, en adelante se hará referencia a los reclamos planteados por el Ministerio Público, únicamente respecto a la cuestión que fue admitida.

III.Primer motivo del recurso del Ministerio Público. En cuanto a la absolutoria de [Nombre 001] por el delito de prevaricato, que se acusa cometido mediante el Decreto Ejecutivo N° 34801-MINAE, el fiscal Carlos Manuel Jiménez Robleto acusa la infracción de los artículos 31, 45, 357 y 363 del CPP, por "Inconformidad con la fundamentación jurídica." Esto así, alega, porque el tribunal incurrió en un error al considerar que la conducta del señor [Nombre 001] es atípica porque no actuó con dolo. La sentencia tiene un yerro en su fundamentación jurídica, al concluir que una de las razones por las que no hay dolo, es que el Ministerio Público no pudo establecer un acuerdo de voluntades entre los imputados, para la realización del delito de prevaricato. Si bien es cierto no existe prueba de que hubo un acuerdo de voluntades entre [Nombre 001] y los miembros de la Comisión Plenaria para suscribir cada una de las resoluciones ilegales –dice el recurrente–, ese elemento no es necesario demostrarlo para la manifestación del dolo, en el tanto que no se acusó una coautoría o complicidad.

IV.Segundo motivo del recurso del Ministerio Público. Se acusa la violación de los artículos 142, 182, 183, 303, 304, 349, 351 y 352 del CPP, por "Inconformidad en la incorporación y valoración de la prueba." El fiscal alega que, en relación a la ilegalidad del Decreto de Conveniencia Nacional N° 34801-MINAE, uno de los argumentos del tribunal penal para absolver al imputado [Nombre 001] fue que no se demostró ninguna presión política o irregular para que se diera la concesión del proyecto Crucitas, sin embargó "cercenó" o "sepultó" la posibilidad al Ministerio Público de demostrar que efectivamente había una presión del Poder Ejecutivo de que otorgara la concesión del proyecto Crucitas. Esto así, porque el tribunal penal resolvió declarar como testigos sospechosos a [Nombre 010] y a [Nombre 011].(en relación a lo que declaró [Nombre 012], director del Área de Conservación Arenal Huetar Norte).

Don [Nombre 010], quien fue geólogo en la Dirección de Geología y Minas, declararía todo lo relacionado a la aprobación de la concesión minera a favor de la empresa Industrias Infinito S.A., los alcances, limitaciones del decreto de moratoria nacional. Don Eduardo declararía que para el año 2008, había ejercido el cargo de jefe de la subregión San Carlos, Los Chiles, fue convocado por directrices del señor [Nombre 001], a una reunión urgente en el MINAE, para que se finiquitaran los permisos forestales a favor de la empresa Industrias Infinito, incluyendo tomar la decisión de la emisión del decreto de conveniencia nacional, así como el conocimiento que tenía el señor [Nombre 001] sobre el tema. Para el Ministerio Público esos testimonios eran fundamentales para demostrar su teoría del caso, de que había una presión política para que se aprobara la concesión, de que el señor [Nombre 001] tenía conocimiento de los pormenores del proyecto y de las dificultades que estaban teniendo, al tener una resistencia del SINAC (Sistema Nacional de Áreas de Conservación) al no otorgar el permiso de cambio de suelo.

Para el momento de que iniciara el interrogatorio de estos testigos, respectivamente, una de las defensas de los imputados solicitó que se les tuviera como testigos sospechosos, alegando que estarían involucrados en alguna de las acciones descritas en los hechos acusados por el Ministerio Público o la Procuraduría General de la República, lo que fue rechazado por el Ministerio Público, que consideró que era necesario escuchar a los testigos, ya que de los hechos acusados no se desprende ninguna responsabilidad penal, por lo que no se podría hacer un análisis previo sin haber escuchado a los testigos, criterio que no atendió el tribunal penal, pues más bien acogió las solicitudes de la defensa y determinó, de manera anticipada, que efectivamente dichos testigos eran considerados sospechosos, por lo que solicitó que se les nombrara un defensor a cada uno de ellos, lo que ocasionó, por el poco tiempo que tuvieron para estudiar el expediente, que los defensores aconsejaron a los testigos abstenerse de declarar y estos, por ser legos, aceptaron ese consejo.

El Ministerio Público concluye que no existía ningún elemento para que el tribunal de juicio estimara que el interrogatorio de estos testigos los pudiera incriminar, por lo que debió permitir el interrogatorio y, en caso de que surgiera alguna manifestación autoincriminatoria, detener la entrevista y nombrarle, en ese momento, un defensor para que lo asesorara. No obstante, el tribunal consideró que esas personas eran testigos sospechosos, por la simple razón de las solicitudes de las defensas de los imputados, las cuales acogió sin sustento alguno, cuando ni siquiera el Ministerio Público les otorgó ese calificativo.

V.Tercer motivo del recurso del Ministerio Público. Se acusa la inobservancia de los artículos 142, 184, 363 inciso b del Código Procesal Penal, por "Inconformidad con la valoración de la prueba, propiamente por falta de fundamentación intelectiva [...] en razón de haberse omitido en sentencia el análisis de los indicios [...] los cuales de haberse analizado, permitirían demostrar que los imputados cometieron el delito de prevaricato". El fiscal Jiménez Robleto critica que el tribunal penal concluyó que el imputado [Nombre 001] suscribió el Decreto Ejecutivo N° 34801-MINAE sin saber que este era ilegal. El recurrente hace hincapié en que ese decreto es ilegal y que lo que lo hace contrario al ordenamiento jurídico es el fundamento de que existía un estudio de costo-beneficio que establecía que el beneficio social y económico era superior al daño ambiental que se iba a ocasionar con la tala del bosque, por lo que el argumento del tribunal de que habían dudas por parte de las diferentes dependencias jurídicas de SETENA (Secretaría Técnica Nacional) y SINAC (Sistema Nacional de Áreas de Conservación) sobre la necesidad o no del Decreto de Conveniencia para el otorgamiento del uso del suelo, no tiene relación con los hechos acusados, ya que de eso no versa el cuadro fáctico acusado.

El argumento del tribunal de que el señor [Nombre 001] tenía un total desconocimiento del contenido del decreto, lo sustenta solo en la declaración de este imputado, dejando de lado la demás prueba testimonial y documental en la que se observa con claridad el papel que, como ministro del MINAE (Ministerio de Ambiente y Energía), jugó para que Industrias Infinito tuviera la concesión de explotación del proyecto Crucitas. Su primera injerencia en el proyecto fue el 21 de noviembre de 2007, cuando en su condición de ministro presentó solicitud de adición y aclaración del voto N° 13414-2004 de la Sala Constitucional, con la que quería saber si la Sala había anulado o no la concesión del proyecto Crucitas. Posteriormente, el 3 de marzo de 2008, el entonces presidente Oscar Arias Sánchez y el ministro [Nombre 001] anularon la resolución R-613-2007-MINAE, en la que se había declarado con lugar un recurso de reposición y se expresó la nulidad de la concesión del proyecto Crucitas por parte del MINAE.

Sin embargo, el imputado [Nombre 001], en vez de mantener dicha resolución, lo que hizo fue archivarla sin resolverla, al declarar el recurso como falto de interés actual. El 18 de abril de 2008, el presidente Arias Sánchez y el ministro [Nombre 001] suscribieron el decreto 34492, el cual derogaba la moratoria nacional de actividad minera metálica de oro (30477-MINAE) Publicado el 4 de junio de 2008 y casi inmediatamente, el 21 de abril de 2008 el endilgado [Nombre 001] en su condición de Ministro del MINAE ordenó la conversión del acto de otorgamiento de la concesión minera, pese a que la Sala Constitucional ya había anulado dicha concesión. Ante la negativa del Área de Conservación Huetar Norte de dar el permiso de uso de suelo, sin que exista un decreto de conveniencia nacional que así lo fundamente, el 13 de octubre de 2008 el imputado [Nombre 001] suscribió el Decreto Ejecutivo N° 34801-MINAE y el 17 de octubre se publicó en La Gaceta.

Esto denota una participación activa de ese acusado en diferentes etapas del proyecto Crucitas, situación que no fue analizada por el tribunal penal en la sentencia. Otro indicio es el corto plazo en que se tramitó el decreto de conveniencia, el tribunal no analiza que la solicitud de cambio de uso de suelo la presentó Industrias Infinito el 9 de setiembre de 2008. El 13 de octubre de 2008 se redactó el Decreto Ejecutivo N° 34801-MINAE y el 17 de octubre se dio el permiso de cambio de suelo y la tala de árboles. A criterio del Ministerio Público, se redactó el decreto de conveniencia nacional con conocimiento de que carecía de los requisitos para su fundamentación, sólo para cumplir con la exigencia del Área de Conservación Huetar Norte y que este otorgara el permiso de cambio de uso de suelo. El estudio que pondera el beneficio social y económico respecto al daño ambiental no se podría haber hecho en menos de un mes.

Tampoco se analiza la forma irregular en que se tramitó el decreto de conveniencia nacional, según la testigo [Nombre 013], testigo que, para el momento de los hechos, trabajaba como directora en la Dirección de Leyes y Decretos y refiere que el llegó a su oficina ya firmado por el presidente Arias Sánchez. La testigo [Nombre 014], quien trabajaba en el departamento legal del SINAC, evidenció otra irregularidad porque nunca les solicitaron el aval o visto bueno, respecto al requisito del estudio de costo-beneficio. El fiscal concluye que de haber analizado estos elementos de prueba se hubiera establecido la responsabilidad penal del imputado [Nombre 001].

VI. RECURSO DE LA PROCURADURÍA GENERAL DE LA REPÚBLICA

El licenciado Christian Hugo Barrero Godínez, Procurador de la Ética Pública ha interpuesto recurso de apelación en contra de la sentencia que el tribunal penal dictó en juicio de reenvío, N° 876-2023 de las 13:30 horas del 20 de noviembre de 2023. Desde un inicio advierte que su recurso se dirige únicamente contra la absolutoria del imputado [Nombre 001], por el Decreto Ejecutivo (N° 34801-MINAE del 13 de octubre de 2008, publicado en La Gaceta N° 201 del 17 de octubre del 2008), que declara de interés público y conveniencia nacional el Proyecto Minero Crucitas. Sostiene que el tribunal penal dictó sentencia absolutoria contra el imputado [Nombre 001], por cuanto consideró erróneamente que el material probatorio ofrecido y recibido en juicio era insuficiente para tener por probado el elemento volitivo del tipo penal de prevaricato, en cuanto al conocimiento y voluntad de las ilegalidades que presentaba el Decreto de Conveniencia Nacional del Proyecto Minero Crucitas, firmado por este.

Plantea dos motivos de impugnación y solicita que se acojan los motivos del recurso, en cuanto se absuelve de toda pena y responsabilidad al imputado [Nombre 001] por la comisión del delito de prevaricato acusado en relación al decreto de interés público y conveniencia nacional del Proyecto Minero Crucitas; que se declare ineficaz la sentencia N° 876-2023 y se reenvíen los autos para su nueva sustanciación. Primer motivo. Acusa la violación de los artículos 142, 182, 183, 303, 304, 349, 351 y 352 del CPP por "Violación a los principios de inmediación y contradicción, por adelanto de criterio." Esto así, alega, en relación a los testimonios de [Nombre 010] (geólogo de la Dirección de Geología y Minas del MINAE, quien declararía todo los relacionado a la aprobación de la concesión minera a favor de la empresa Industrias Infinito, los alcances, limitaciones del decreto de moratoria nacional y la conversión del acto de concesión minera), [Nombre 012] (director del Área de Conservación Arenal Huetar Norte, quien declararía que para el año 2008, ejerciendo el cargo de Director del Área de Conservación Arenal Huetar Norte, fue convocado a una reunión urgente en el MINAE, para que finiquitaran los permisos forestales a favor de la empresa Industrias Infinito, incluyendo tomar la decisión de la emisión del decreto de conveniencia nacional, así como el conocimiento que tenía el señor [Nombre 001] sobre el tema) y [Nombre 011] (quien declararía que para el año 2008 había ejercido el cargo de Jefe de la Subregión San Carlos Los Chiles, y que fue convocado por directrices del señor [Nombre 001] a una reunión urgente en el MINAE, para que se finiquitaran los permisos forestales a favor de la empresa Industrias Infinito, incluyendo tomar la decisión de la emisión del decreto de conveniencia nacional, así como el conocimiento que tenía el señor [Nombre 001] sobre el tema).

Cuando iba a iniciar el interrogatorio de cada uno de estos testigos, una de las defensas de los imputados solicitó que se les tuviera como testigos sospechosos, alegando que estarían involucrados en alguna de las acciones descritas en los hechos acusados por el Ministerio Público y la Procuraduría General de la República, a lo que se opusieron los representantes de estas dos entidades, por las razones que la jurisprudencia ha resuelto, de que no se puede adelantar un criterio por parte de los juzgadores, sino es hasta que se demuestre en el propio relato de los deponentes si existe o no una auto incriminación, criterio que no atendió el tribunal penal, pues más bien acogió las solicitudes de la defensa y determinó, de manera anticipada, que efectivamente dichos testigos eran considerados sospechosos, por lo que solicitó que se les nombrara un defensor a cada uno de ellos. Por razones obvias de tiempo, los defensores optaron por lo más sano y rápido, como fue recomendar a sus representados que se abstuvieran de declarar, sin saber a fondo si los presuntos testigos sospechosos se encontraban o no involucrados, por lo que considera que el tribunal penal actuó de manera arbitraria, al adelantar criterios infundados, sin que los testigos se hubieran auto incriminado, coartando el acceso del Ministerio Público y de la Procuraduría General de la República a la prueba.

Subraya que en este asunto no concurrió ningún dato objetivo revelador de que el interrogatorio en juicio propiciara una autoincriminación de estos testigos; que la existencia de una autoincriminación se debe determinar a partir del propio relato de los deponentes y no de forma anticipada, como fue en el presente caso, por un adelanto de criterio. El tribunal consideró que dichas personas eran sospechosas, por la simple solicitud de las defensas de los imputados, las cuales acogieron sin sustento alguno y adelantando criterio, cuando ni siquiera el Ministerio Público les otorgó ese calificativo, ni siguió algún tipo de investigación en su contra, solo se les menciona en los hechos acusados pero no se les imputa ninguna acción punible, por lo que no había impedimento alguno para evacuar sus testimonios. El proceder del tribunal "sepultó" una prueba fundamental para el Ministerio Público y la Procuraduría General de la República, al anticiparse injustificadamente a hacer las advertencias legales a los testigos referidos sin haber escuchado sus manifestaciones en el plenario, lo que causa un agravio a los intereses del Estado en su papel de actor penal, porque "suprimió indebidamente pruebas que pudieron ser esenciales, para comprobar el elemento doloso del delito de prevaricato, que el mismo tribunal argumenta en sentencia, que no fue comprobado en su criterio con la prueba recibida en juicio, debido a la propia actuación del tribunal de lesionar los principios de inmediación y contradicción en el proceso, al prescindir de forma arbitraria de estas pruebas."

VII.Segundo motivo del recurso de la Procuraduría General de la República. Se acusa la violación de los artículos 142, 182 y 184 del Código Procesal Penal, por "Falta de fundamentación intelectiva en la valoración de la prueba". Alega que el tribunal incumplió ese articulado porque, en lugar de indicar los motivos por los cuales le otorgó un determinado valor a las pruebas, únicamente explicó las razones por las cuales consideró que no hay prueba directa ni indicios suficientes que permitan tener por probado el elemento volitivo del tipo penal de prevaricato, pero sin establecer qué valor le otorga a las pruebas debidamente ofrecidas y recibidas en juicio. Únicamente realiza una transcripción de los testimonios recibidos en juicio, no valora los indicios que se extraen de la prueba, que demuestran las irregularidades presentes en la tramitación, firma y publicación del decreto de interés público y conveniencia nacional del proyecto minero Crucitas N° 34801 del 13 de octubre de 2008, que denotan la intención del imputado de agilizar el trámite de aprobación del decreto y con ello evitar los controles de otros departamentos que intervienen en este proceso, con la finalidad de que no fuera conocida la falta de requisitos necesarios para proceder con la declaratoria de conveniencia nacional.

Los testigos [Nombre 014], [Nombre 018], [Nombre 015], son contestes en mostrar las irregularidades que presentaba el decreto N° 34801, que requería estar fundamentado en un estudio de costo-beneficio y formar parte de la fundamentación del decreto y se puede derivar razonablemente que el imputado, que era ministro de Ambiente, conocía esa falencia.

Otra irregularidad en la aprobación del decreto fue la urgencia en su tramitación, aspecto que refieren los testigos [Nombre 015] y [Nombre 016], [Nombre 017] y [Nombre 013] y que es concordante con la prueba documental ofrecida y recibida en juicio, la cual demuestra la rapidez con que fue publicado el decreto, el cual fue emitido el 3 de octubre de 2008 y ya para el 17 de octubre de ese mismo año había sido publicado en La Gaceta N° 201, el mismo día que se aprobó la solicitud de cambio de uso de suelo por el Área de Conservación Arenal Huetar Norte.

Con base en los testimonios indicados se pueden tener por acreditadas las irregularidades presentes en el trámite de aprobación del decreto N° 34801, la agilización del procedimiento es un claro indicio de la intención del imputado de favorecer al proyecto minero Crucitas y de evadir revisiones, como la revisión que se realiza en la Dirección de Leyes y Decretos, al llegar el decreto firmado por el presidente Arias Sánchez.

Por lo anterior yerra el tribunal penal al fundamentar la absolutoria en una supuesta falta de prueba directa o indicios que comprueben el elemento subjetivo del tipo penal de prevaricato, pues los indicios sí permitirían comprobar el conocimiento que tenía el imputado [Nombre 001] de las falencias e ilegalidades que tenía el decreto firmado por su persona. Conforme al principio de libertad probatoria, en este caso sí se podría demostrar que el acusado actuó con dolo a partir de una análisis conjunto y armónico de la prueba testimonial y documental, pero que no realizado por el tribunal penal, causando un agravio al Estado, específicamente a los Deberes de la Función Pública y al ambiente, por lo que solicita que se declare ineficaz la sentencia impugnada y que se ordene el reenvío para su nueva sustanciación.

VIII.Se resuelven los reclamos planteados. Como se adelantó en los Considerandos I y II de la presente resolución, los recursos de apelación interpuestos por el Ministerio Público y la Procuraduría General de la República, fueron formalmente admitidos –por efecto del artículo 466 bis del Código Procesal Penal– únicamente en cuanto la sentencia N° 876-2023 dispuso absolver al imputado [Nombre 001] por el dictado del Decreto Ejecutivo N° 34801-MINAE de las 13:00 horas del 13 de octubre de 2008 (publicado en La Gaceta N° 201 del 17 de octubre del 2008), que declaró de interés público y conveniencia nacional el Proyecto Minero Crucitas.

A partir de esa delimitación, se observa que los motivos planteados en ambos recursos de apelación, en síntesis, tienen en común una crítica del análisis y valoración de la prueba que realizó el tribunal en torno a la determinación del conocimiento y voluntad (dolo) que orientó la conducta del imputado [Nombre 001] y el reclamo por la incidencia que las conclusiones del tribunal penal al respecto tuvieron en la aplicación de la ley sustantiva, pues ambos recurrentes consideran que un correcto examen de la prueba hubiera permitido extraer una serie de indicios tales que, unidos entre sí, permitirían sustentar, con certeza, que el imputado [Nombre 001] sí tuvo conocimiento y voluntad de dictar el Decreto Ejecutivo N° 34801, a sabiendas de que era una resolución contraria a la ley o de que se fundaba en hechos falsos, por lo que –sostienen ambos recurrentes– sí se le podría considerar autor de un delito de prevaricato, previsto y sancionado en el artículo 357 del Código Penal. Al existir esa coincidencia en los reclamos planteados, se procede a resolverlos de manera conjunta, para evitar reiteraciones innecesarias.

En el Considerando II de la sentencia examinada –en lo que aquí interesa– el tribunal penal advierte que en las acusaciones no se estableció de manera concreta y específica la determinación del aspecto subjetivo del tipo penal (dolo) en cuanto a la confluencia de voluntades o plan común por parte de los imputados para que se otorgara de manera ilícita la concesión minera a favor de Industrias Infinito S.A.; y que del examen de la prueba, concretamente de los indicios, no se deriva la existencia de una conducta dolosa (cfr. Sentencia, págs. 128 a 135).

Entre las páginas 135 a 144 de la Sentencia, se desarrolla un examen general sobre la responsabilidad de todos los acusados, según el cual sus conductas son atípicas respecto al delito de prevaricato que se les ha venido atribuyendo, por ausencia de dolo. La circunstancia de que el Decreto Ejecutivo N° 34801-MINAE haya sido anulado por el Tribunal Contencioso Administrativo (mediante resolución N° 4399-2010 de las 10:40 horas del 14 de diciembre de 2010, que devino confirmada por la resolución de la Sala Primera de la Corte Suprema de Justicia N° 1469 de las 9:00 horas del del 30 de noviembre de 2011), no implica que los funcionarios implicados en su dictado tuvieran el conocimiento y voluntad de resolver en contra de la ley o basándose en hechos falsos:

«Cabe acotar que, no se descarta que las infracciones al Ordenamiento Jurídico que fueron constatadas y puestas de manifiesto por el Tribunal Contencioso Administrativo hayan obedecido a falencia, desconocimiento o simple error por parte de los imputados, pero para los efectos que aquí interesan, tenemos que no se acreditó que ello se debió a un actuar deliberado en el accionar de los acriminados. Considerar que la simple declaratoria de nulidad de las resoluciones realizada por el Tribunal Contencioso Administrativo es suficiente para tener como prevaricadora la actuación de un funcionario público conllevaría en la práctica a la desaparición de la responsabilidad disciplinaria y restaría consecuentemente para los jueces o administrativos que dicten resoluciones contrarias a la ley, la perenne situación de verse sometidos al escarnio de un proceso penal, esto por cuanto existe un innegable margen de apreciación cuando se procede a aplicar la ley a un caso concreto, cuando se definen sus alcances, al darle sentido, interpretar lo que ella establece para una generalidad de casos y en esto hay que tener presente siempre que el Ordenamiento Jurídico es un todo sistemático, pero también bajo la consideración de que es un sistema, que de acuerdo con los más reconocidos autores, nunca habrá de considerarse como algo definitivo y acabado –lo cual resulta lógico–, sino siempre como algo susceptible de modificación y de nueva armonización cuando sea preciso incorporar a el nuevos principios de enfrentamiento con nuevos problemas.

La tarea del intérprete entonces no es ni será nada fácil, hay que ir superando todas las aparentes contradicciones que van surgiendo de las soluciones de los distintos problemas y en ir armonizando esas soluciones en un sistema en constante cambio, por lo que –se insiste– la labor de interpretación es una actividad que implica un análisis agudo y elaborado...» (sic, Sentencia, págs. 137 a 138).

Entre las páginas 144 a 146 se hacen algunas explicaciones generales sobre el examen y valoración de la prueba indiciaria.

Respecto al imputado [Nombre 001], entre las páginas 146 a 174 de la sentencia, el tribunal penal explica las razones por las cuales considera que son atípicos los dos hechos acusados en su contra: a) el referido al Decreto Ejecutivo N° R-217-2008-MINAE (respecto al cual operó el efecto previsto en el artículo 466 bis del Código Procesal Penal, porque la sentencia impugnada reiteró la absolución que había sido dispuesta en la sentencia N° 32-2015); y b) el que se refiere al Decreto Ejecutivo N° 34801, que declaró de interés público y conveniencia nacional el Proyecto Minero Crucitas y que es objeto del presente examen. Con relación a este último, el núcleo del hecho acusado por el Ministerio dice así:

«30. Es así como la cómplice [Nombre 006] para ese entonces en su condición de Secretaria General de la Secretaría Técnica Nacional Ambiental, con el fin de favorecer los intereses del desarrollador y prestar colaboración al coencartado [Nombre 001], a sabiendas que la emisión de decretos ejecutivos de conveniencia nacional, así como su necesario presupuesto de balance beneficio social-costo socio ambiental, es competencia exclusiva del Poder Ejecutivo, según la excepción prevista en los artículos 19 inciso b) y 34 de la Ley Forestal, atribuyéndose funciones que no le corresponde, emitió el oficio número SG-ASA-259-2008 de 10 de octubre de 2008, dirigido al señor [Nombre 019], e indicó que el balance obtenido mediante los instrumentos apropiados permitió establecer que los beneficios sociales económicos son mayores que los costos ambientales, instrumentos que no se aplicaron para la emisión del decreto ejecutivo de conveniencia nacional.

31. Es así como el encausado [Nombre 001] en calidad de Ministro de ambiente Energía y Telecomunicaciones actuando como Poder Ejecutivo, sin que el proyecto reuniera las condiciones legales para ser declarado de conveniencia nacional, con el auxilio prestado por la cómplice [Nombre 006] al suscribir el oficio número SG-ASA-259-2008, emitió el Decreto Ejecutivo N° 34801-MINAET, de fecha 3 de octubre del año 2008, publicado en la Gaceta N° 201, del 17 de octubre del 2008, con lo que declaró de conveniencia nacional el Proyecto Minero Crucitas, contrariando de esta forma lo dispuesto en los artículos 3 inciso m, 19 inciso b y 34 de la ley forestal, así como el artículo 361 de la Ley General de Administración Pública» (sic, Sentencia, págs. 11 a 12).

Mientras que en la querella de la Procuraduría General de la República se describe así:

«45.-A raíz de la solicitud del Director del Área de Conservación Arenal- Huetar Norte, la encartada [Nombre 006], actuando en su condición de Secretaria General de la SETENA, con el fin de favorecer los intereses de las empresa Minera industrias Infinito S.A. y de colaborar con el también coimputado [Nombre 001], teniendo pleno conocimiento que los Decretos de Conveniencia Nacional resultan ser una competencia exclusiva del Poder Ejecutivo, según la excepción prevista en el artículo 19 inciso m) y 34 de la Ley Forestal, tomándose atribuciones que no le competían, emite el oficio SG- ASA-259-2008 del 10 de octubre de 2008 dirigido al señor [Nombre 019], mediante el cual, asevera que el balance obtenido mediante los instrumentos apropiados permitió establecer que los beneficios sociales económicos son mayores que los costos ambiéntale. Esta afirmación la realiza la encartada [Nombre 006] sin que tuviese fundamento alguno, pues no existe evidencia que los instrumentos a que hace referencia en el oficio de referencia fueran aplicados para emitir el decreto de conveniencia nacional.

  1. 46Es así como, con la ayuda de la imputada [Nombre 006] al suscribir el oficio SG-ASA-259-2008, el Ministro de Ambiente de entonces y ahora imputado, [Nombre 001], emite ilícitamente, en conjunto con el Presidente de la República para la fecha, Oscar Arias Sánchez, el Decreto Ejecutivo N° 34801-MINAET, publicado en La Gaceta N° 201 del 17 de octubre del 2008, el cual declara de interés público y conveniencia nacional el Proyecto Minero Crucitas. Decreto que resulta violatorio del ordenamiento que rige la materia, en cuanto al procedimiento, el motivo y la fundamentación, pues se inobservó groseramente la normativa establecida en el artículo 3 inciso m de Ley Forestal y artículo 2 del Reglamento a la Ley 7575 sobre requisitos de declaratoria de conveniencia nacional, así como el numeral 6. 6 del Código de Minería sobre declaratoria de utilidad pública. Entre las violaciones al procedimiento se encuentra -entre otros aspectos-, que se omitió conceder a las entidades representativas de interés, ya sea de carácter general o corporativo, los plazos establecidos en la Ley, para que estás organizaciones de la sociedad civil se pronunciaran sobre el proyecto; en cuanto a aspectos de fundamentación, no tiene un asidero técnico para su declaratoria, pues no se realizó análisis sobre variables sociales y económicas de la zona del proyecto.» (sic, Sentencia, pág. 24).

Entre las páginas 153 a 174 se examina propiamente este extremo de las acusaciones, desarrollando la tesis central de que:

«No basta, entonces que se disponga una resolución administrativa objetivamente contraria a la ley para que existe el delito de Prevaricato, sino que es necesario que el autor realice la acción con conocimiento de que la resolución que se adopte es ilegítima y su deseo de actuar con ese conocimiento, lo que debe quedar acreditado, no se puede presumir ni verificarse por simple ficción, por exigencia del artículo 34 del Código Penal, a partir de ese numeral, es claro deducir que el sujeto activo debe conocer las circunstancias fácticas descritas en el tipo penal» (Sentencia, pág, 156).

El tribunal penal valora que en el dictado del Decreto Ejecutivo N° 34801 intervinieron varios órganos administrativos, se dieron varios criterios, incluso encontrados, pero que nunca fue advertida ninguna ilicitud o contradicción con el ordenamiento jurídico, algún vicio en el procedimiento, en el motivo o en su fundamentación. La redacción del decreto se encomendó a la Dirección Jurídica del Ministerio del ambiente, que está compuesta por varios abogados. La Oficina de Leyes y Decretos de la Casa Presidencial, conformada también por abogados expertos, que también es un filtro de control de la corrección y legalidad de los decretos antes de que estos sean publicados, tampoco detectó los vicios que señaló el Tribunal Contencioso Administrativo, por lo que el tribunal penal considera que no se visualiza la existencia del dolo que supone el delito de prevaricato, sino un decreto viciado por errores en el procedimiento administrativo o en la interpretación de sus requisitos legales, lo que desarrolla en los siguientes términos:

«Siguiendo esa inteligencia, dado que el delito de Prevaricato prevé como elemento objetivo que la decisión que se adopta sea contraria al Ordenamiento Jurídico y que su acción es voluntaria, no es suficiente para tener por configurado esta delincuencia la sola constatación del quebranto de las normas -en la forma y de acuerdo con lo que de manera detallada lo tuvo por acreditado el Tribunal Contencioso Administrativo, «pues sin duda se borraría esa la línea a la que aludimos en las líneas del considerando inicial de esta sentencia y llevaría a la desaparición de la responsabilidad disciplinaria, normalizando la persecución penal contra los funcionarios públicos en todos aquellos supuestos en que el Tribunal Contencioso Administrativo o un Tribunal de alzada (en los casos judiciales) disponga la anulación del acto o de la resolución, por considerar que son contrarios a derecho. Pero además, en esta inteligencia, es preciso tener en cuenta, por ser el rasgo tradicional del concepto de dolo, la exigencia de que el conocimiento se configura como un fenómeno cuya concurrencia deba darse en el momento de la realización delictiva, por lo tanto dicho proceso fenoménico debe ser efectivamente constatado en el proceso penal.

En el presente caso no existe fundamento a partir del cual se pueda establecer válida y convincentemente que el imputado [Nombre 001], en su condición de Ministro del Ambiente emitió el Decreto al que se viene haciendo referencia, con consciencia y voluntad de violentar el Ordenamiento Jurídico, lo cual resulta esencial -no tangencial-, ya que el Prevaricato al ser una ilicitud intencionada, es decir, fundamentalmente dolosa, para su configuración debe demostrarse que el sujeto activo actuó con voluntad y conocimiento de que al resolver un asunto lo está haciendo en contra de la ley o bien partiendo de hechos falsos. De la transcripción que se hizo en lo conducente del voto del Tribunal Contencioso Administrativo y que constituye la hipótesis acusada y querellada, este Tribunal logra establecer básicamente que el aquí encartado [Nombre 001], en ese tiempo Ministro de Ambiente, actuando conjuntamente con el Presidente de la República, suscribió el Decreto de Conveniencia Nacional que al final fue anulado por el Tribunal Contencioso -nada más-.

La atribución de responsabilidad por parte de los acusadores en el presente caso no aparece sustentada en prueba directa y los indicios que se mencionan no son suficientes para acreditar una actuación dolosa; y por otra parte, se detecta que por parte de los acusadores no hay coherencia ni corrección argumental en la subsunción del tema del dolo. Siendo así, al quedar desvirtuado el dolo en el proceder del aquí imputado [Nombre 001], no puede configurarse el delito que se le atribuyó y consecuentemente su conducta resulta atípica. En todo caso, como vamos a ver en detalle, a partir de las pruebas que se introdujeron al juicio y de la declaración rendida por el imputado [Nombre 001], tenemos que el comportamiento que se le ha venido endilgando no está tampoco cercano a lo que pueda válidamente considerarse como una conducta prevaricadora. Como punto de partida tenemos entonces que ni se sostuvo correctamente por los acusadores, ni se acreditó con grado de certeza un comportamiento intencional, doloso por parte del señor [Nombre 001].

Para respaldar lo que hemos indicado, no puede negarse que para la emisión del Decreto de Conveniencia Nacional se tuvo que ponderar los intereses en juego, sin que pueda perderse de vista la relación que existe siempre entre el tema del impacto al Ambiente y los Derechos Humanos, tema ya hemos puesto de relieve aquí, pero basta con mencionar que indiscutiblemente la temática del ambiente, tratándose de un derecho fundamental, recorre transversalmente todo el Ordenamiento Jurídico y precisamente por ello, todas las decisiones que se toman comportan cierta complejidad, pues están involucradas muchas leyes, decretos, participan varias dependencias administrativas -algunas en cuestiones meramente técnicas y otras en cuestiones jurídicas-, lo que no puede dejarse de lado por la importancia que tienen para la solución de este caso, por lo que vamos a volver luego. Cabe acotar además que no puede escindirse este Decreto de Conveniencia Nacional con el tema del permiso de cambio de Uso de suelo en el terreno que es propiedad de la empresa.

Al respecto, el artículo 19 inciso b) de la Ley Forestal establece una excepción a la protección general del bosque, cuando está de por medio la "conveniencia nacional", es en este supuesto que debe hacerse el balance entre los beneficios sociales, los cuales deben ser mayores que los costos socio-ambientales. La norma ciertamente establece una regulación amplia en cuanto a sus términos y es bastante compleja de captar, por lo que debe admitirse de manera tranquilizante que su aplicación es tarea nada fácil. Se hace ver que fue objeto de una acción y hubo pronunciamiento por parte de la Sala Constitucional en la sentencia número 2006-17126. Parafraseando a la Sala, se resolvió que analizados los principios rectores en materia ambiental, dicha norma, en relación con el 34 del mismo cuerpo legal, no resultan contrarios al derecho a un ambiente sano y ecológicamente equilibrado, siempre y cuando no sea una autorización para que las instituciones públicas lesionen "legítimamente" el ambiente, ni tampoco de un régimen de excepción.

(Cfr. Voto número 2006-17126 de la Sala Constitucional). De acuerdo con este fallo, la posibilidad de cambio de uso del suelo queda reservada únicamente al patrimonio forestal privado, por lo tanto, es claro que las normas que fueron cuestionadas en la jurisdicción constitucional sí prevén la posibilidad del cambio del uso del suelo en los inmuebles privados sobre los que pesa la afectación cuando exista cobertura boscosa, lo cual resulta necesario, ya que solo así es posible permitir la construcción de las obras de infraestructura, pues es sería iluso pensar en una actividad minera sin la construcción de obras de infraestructura necesarias para la materialización de la extracción de los minerales, como caminos, lagunas de deslave, casetillas y demás. En consecuencia todo queda sujeto desde luego a la normativa ambiental vigente en el momento. Así, ante la finalidad del interés general de la colectividad nacional se deben ponderar ambos derechos y equilibrar su utilización atendiendo al principio de desarrollo humano sostenible, lo que se entiende como la necesidad de una inter-relación equilibrada entre los elementos críticos del desarrollo económico (turismo, inversión, empleo, infraestructura, finanzas sanas y sistema tributario) de la política social (educación, salud, seguridad) y de la protección medio ambiental.

Al respecto, por la importancia que tiene para lo que se resuelve, se indicó en ese voto: "Este desarrollo ha sido definido por la Organización de las Naciones Unidas, como la ampliación de las opciones para todas las personas de una sociedad, el cual es un concepto comprensivo porque incluye a los hombres y mujeres como centro del desarrollo, la protección de las oportunidades en la vida de las futuras generaciones y los sistemas naturales de los que depende la vida en su totalidad. El propósito fundamental es la creación de un ámbito posibilitante en que todos puedan disfrutar de vidas largas, saludables y creativas, ya que el crecimiento económico también es un medio para el desarrollo humano. De ahí que lo relevante es permitir un desarrollo industrial y tecnológico de los pueblos, pero tolerable al utilizar el entorno físico y social, con el fin de logra un progreso económico y social.

La responsabilidad consiste en equilibrar la protección del ambiente, el desarrollo económico y las actividades de los particulares, que justifique la intervención del Estado." (Cfr. Voto 2006-17126 de la Sala Constitucional). De acuerdo con esto, siguiendo lo que hemos venido sosteniendo, de que es preciso situar el análisis del comportamiento que se atribuye como prevaricador en el momento histórico en que se adopta el mismo, ya que el dolo como conocimiento concurre al momento de la realización delictiva, entendido esto de otra manera, habría un mal entendimiento del merecimiento de la pena como factor corrector de la imputación penal y no puede dejar de decirse que gran parte de los errores que se han presentado con la imputación penal en este caso, obedece a esta visión distorcionada de las cosas, lo que puede verse sin esfuerzo que la disyuntiva que intuititva y tácitamente se ha venido planteando desde el inicio, y como se ha podido ver, en el desarrollo del estudio de los casos, hay una diferencia importante entre lo que deba entenderse como "determinación" o "atribución" del dolo.

Siguiendo con esto, es entonces cuando se sopesó ese "equilibrio" que debe darse entre la protección del ambiente y el desarrollo económico, esto es precisamente ese engarce o correspondencia entre los fines declarados en el Plan Nacional de Desarrollo que menciona el imputado [Nombre 001] en su declaración y que el Tribunal ha podido constatar, siendo que en ese Plan Nacional asumido por la Administración del gobierno en el que figuró como Ministro, se aprecia que efectivamente la actividad minera -en términos generales y no exclusivamente el proyecto Crucitas-, se tenía como importante para generar fuentes de empleo y bienestar a las comunidades, por lo que era meta de encumbrado interés impulsarla y eso lo aceptó el imputado cuando declaró, siendo patente que el tema de la minería en dicho gobierno no era un tema arcano. Solo a partir de este esquema de análisis se puede determinar si el comportamiento que se le enrostra al aquí imputado y a la supuesta cómplice la coimputada [Nombre 006], puede considerse doloso y consecuentemente típico, si es que queremos acercarnos al ideal del derecho como lo justo , y de esta manera evitar el grave riesgo de desplazamiento del centro de gravedad del injusto, desde lo imprudente o impune hacia lo doloso y eliminar toda posibilidad de atribución de una responsabilidad objetiva determinada por el simple hecho de ser el máximo jerarca del Ministerio de Ambiente en cuyo seno se generó el Decreto.

En el contradictorio el imputado [Nombre 001] no solo ha negado los cargos sino que se ha referido de manera puntual y amplia a los cargos que se le han endilgado. Con respecto a lo declarado por el testigo [Nombre 020], advierte que entre ellos ha existido -viene de viejo- desaveniencias importantes por sus diferentes posiciones políticas en temas que evidentemente tienen incidencia sobre el ambiente, como la explotación petrolera y la minería: "antes de las elecciones de febrero de dos mil seis, mi relación con él no era buena, fui Ministro de Ciencia y Tecnología, Presidente del ICE y de RECOPE, las relaciones no eran buenas, ya que yo formé parte durante el gobierno de una Comisión especial mixta en la Asamblea, se buscaba la reforma del ICE. Tuvimos discusiones, él continuó con cierta rivalidad conmigo, antes de las elecciones de 2006 no tuvimos rivalidad. En cuanto al período de transición, don Oscar Arias, manifestaciones sobre lo que Abel venía haciendo, muchas diferencias, por eso muchos Ministros no se reunieron, no hay ninguna normativa que obliga a reunirse con lo ex ministros, yo les explique lo que el gobierno iba a hacer relación con el Plan Nacional de Desarrollo, Mideplan, aquí tengo una copia de este plan, que sale publicado vía decreto, primero no es cierto que yo fui a hablar solo de minería y petróleo, él no estaba contento con la nueva visión del gobierno entrante, las telecomunicaciones pasaron al Ministerio de Energía y Minas, se pasó a llamar MINAET.

Se buscaba que el I.C.E. tuviera un solo Ministro rector. No hablamos del tema petróleo. Con relación a este tema, yo conocía la posición de ellos, por eso las dos exploraciones petroleras habían sido dadas en el gobierno de Miguel Ángel Rodríguez. Él era viceministro cuando se dio la primera concesión a Industrias Infinito, yo ya sabía que el gobierno de Abel Pacheco se oponía a todo lo que era exploración petrolera y minería." Y agregó también: "Luego de ser Ministro él siguió con bastante animosidad contra mí, muestra un titular del Semanario Universidad, que no soy experto en cambio climático y nos representa mal. Antes de este debate no he conversado con él, participé en un foro, él era expositor, por video conferencia, pero no conversamos." Siguiendo, el imputado [Nombre 001] dejó en claro que él no participó personalmente en la redacción del Decreto número 34801-MINAET por ser esta una labor eminentemente jurídica y que además porque su confección involucraba, desde el punto de vista técnico, a otras dependencias administrativas del Ministerio.

Al respecto fue enfático al reconocer que todos estos funcionarios él los conocía y eran de su entera confianza y que fue a ellos a quienes les encargó la labor de la redacción del Decreto. Indicó que dentro del organigrama del Ministerio se dieron cambios importantes a partir del momento en que él asumió el cargo de Ministro de Ambiente, en concreto afirma que el Ministerio se fortaleció con la creación de los Viceministerios que a su vez asumían Áreas específicas, siendo que el Ministro se encargaría de ejercer de coordinador de las políticas públicas, particularmente las que en ese momento eran de interés del gobierno y que habían sido anunciados públicamente y aparecen definidos en el correspondiente Plan Nacional de Desarrollo, en el que se contemplaba la minería como actividad que vendría a generar fuentes de empleo para el país, por lo que era de interés del gobierno fomentar dicha actividad, cabe destacar de su declaración en juicio lo siguiente: "La visión del nuevo gobierno, el país debía buscar fuentes de desarrollo, estaba en el Plan Nacional de Desarrollo, en las discusiones políticas, pero todo conforme a la Ley.

En tema de minería, el nuevo gobierno no veía la minería mal, pero en el tanto que se hiciera todo conforme a la ley. La gente que participó, despacho del Ministro, Departamento de Asesoría legal, los del Sistema de Áreas de conservación, es decir, todos los despachos participaron de acuerdo con la ley." El señor [Nombre 001] niega cualquier tipo de injerencia sobre la SETENA. En lo que concierne a la redacción de los documentos, decretos y demás actos administrativos, incluyendo el Decreto de Conveniencia Nacional del proyecto Crucitas, reconoce que efectivamente él giró la instrucción de que ello fuera redactado, porque así lo había solicitado el Director del Área de Conservación Huetar Norte, pero eso, como todo lo que pasaba para ser firmado al Despacho del Ministro, seguía un rigoroso íter, pasaba por diferentes Oficinas, primordialmente destaca que se encomendó la redacción del Decreto a la Dirección Jurídica del Ministerio de Ambiente, haciendo ver como otro de los cambios a partir de su paso por el Ministerio, que este Departamento era el otrora Departamento Legal, además, pasaba por el filtro de la abogada del Despacho del Ministro, quien tenía la labor de revisar previamente lo que venía de la Dirección Jurídica, además, tenía que ser enviado al Departamento de Leyes y Decretos de Casa Presidencial y ellos lo tenían que revisar.

Sobre esto el imputado declaró lo siguiente: "En el caso de la concesión minera a Crucitas, yo no tuve ninguna injerencia en la SETENA. En cuanto a la clasificación de los dos tipos de decretos, yo había sido antes Ministro, hay uno solo, Decretos Ejecutivos y punto. Había un equipo que revisaba, tengo una guía con datos sobre este tema, es importante, es una guía sobre cómo se manejó este tema, es importante indicar que el Ministerio iba tener cuatro Vice Ministerios, cada Viceministerio iba tener un Viceministro, uno de Energía, Comunicaciones, Agua, cada uno coordinaba sus diferentes Áreas. Todos estaban bajo supervisión, los viceministros, todo sale en el nombramiento del Presidente, quien los nombra. Cuando me llega para la firma un documento, primero el Departamento legal, Dirección de Asesoría jurídica, antes se llamaba Departamento Legal, todos los documentos que el Ministro firmaba, para esto de la concesión minera, primero el Viceministerio, luego a la Dirección de Asesoría jurídica, la Dirección de Geología y Minas, SETENA y el SINAC, el SINAC es muy grande, tiene once Áreas, con su autonomía y tiene un Director Ejecutivo y cada Área tiene un Director.

Son seis instituciones dentro del MINAE que tuvieron que ver con esto, conocían bien esto, además de esto, en el Despacho yo tenía una abogada Ana Luisa Leiva, ella estaba en despacho, ella revisaba todo lo que el Ministro iba firmar, a veces grandes cantidades, si había algo que no le parecía, ella lo devolvía, una vez pasado por todo este trámite, el Ministro firmaba por disposición legal, son actos del Poder Ejecutivo. La resolución que otorgó la concesión, Ana Luisa recogió la firma, se devolvía a la Dirección de Asesoría Jurídica para enviarlo a la Dirección de Leyes y Decretos, ubicada en Zapote, luego de aquí, pasaba nuevamente a la Dirección de Asesoría Jurídica, al despacho del Ministro solo llegaba una vez. En relación con el Decreto de Conveniencia Nacional, en relación con la tramitología la respuesta es la misma, mismo trámite. Nadie me llamó para insistirme que agilizara estos trámites de estos dos documentos.

Nadie me indicó que no debía firmar estos documentos, además venía con nota formal, señor Ministro sírvase firmar, venía con la firma del Viceministro, para mi ello me llegaba y que todo estaba correcto." Se infiere también de su declaración que cuando se le presentó para firmar el Decreto éste venía con el visto bueno de la Jefa del Departamento Legal, la licenciada [Nombre 018], siendo una costumbre en la tramitación de este tipo de actos, anotar para su validación por parte de la Jefatura de la Dirección Jurídica que lo que se le presentaba para firmar contaba con el "visto bueno" y se estampaba el sello respectivo de dicha Dirección, sobre este particular el imputado dijo: "La solicitud del dictado de Decreto de Conveniencia sale del Área de Conservación Huetar Norte, que era necesario, todo eso va a la Asesoría Jurídica, yo no participé en la redacción, yo tenía plena confianza, se me manda formalmente, como todo lo que yo tenía que firmar, todo tiempo había concesiones, de telecomunicaciones, de aguas, yo no firmaba nada si no venía con el visto bueno del Área legal, e incluso se le ponía el sello.

En el momento de la firma, yo firmé con toda confianza." En el debate se pudo corroborar que efectivamente en el expediente en que se tramitó el Decreto Ejecutivo, se aprecia el visto bueno de la Jefe licenciada [Nombre 018], seguido de la leyenda: "sírvase encontrar adjunto para su respectiva firma..." En su declaración niega haberse reunido con personeros de Industrias Infinito, nunca visitó el proyecto minero Crucitas y en cuanto al ex Presidente Oscar Arias, afirma que él nunca lo presionó por este tema de la concesión y en general nadie lo presionó. Finalmente, el imputado en su declaración menciona la existencia del Voto de la Sala Constitucional que validó lo actuado con respecto a este Decreto de declaratoria de Conveniencia Nacional, indica que la Sala consideró que todo estaba bien. Además, refiere que le causa extrañeza que la Procuraduría dentro del proceso Contencioso Administrativo defendió todas las actuaciones de los funcionarios administrativos en torno a la concesión minera a favor de Industrias Infinito.

El Tribunal ha hecho lectura del Voto, vemos que cuando se refiere al balance de los beneficios económicos y sociales para la autorización del cambio de suelo, ante la solicitud presentada por Industrias Infinito para el cambio del uso del suelo ante el Área de Conservación Huetar Norte, de previo a conocer y valorar el punto, se solicitó la declaratoria de conveniencia nacional y se deja constancia en el fallo que sobre este tema se había dado una discusión sobre la necesidad o no de solicitar tal declaratoria y no fue sino hasta el 24 de setiembre de dos mil ocho, mediante el Oficio número 695-2008 SC, que la Subregión San Carlos-Los Chiles, del Área de Conservación Huetar Norte del SINAC le comunica a la empresa Industrias Infinito que sí se requiere el Decreto de conveniencia nacional para poder resolver la solicitud de cambio de uso de suelo. Con esto lo que se quiere dejar de manifiesto es que no era algo que se podía dar por sentado por ser claridad y las discusiones tuvieron lugar en el seno precisamente del Área de Conservación, que la dependencia administrativa encargada de velar cumplidamente por la normativa forestal y más concretamente, tenemos con la intervención de la asesoría jurídica, no es era un tema pacífico.

Como la solicitud de condena en contra del encartado [Nombre 001] se ha sustentado en el hecho de considerar que el Decreto Ejecutivo número 34801-MINAET se fundamenta en un hecho falso, propiamente por haberse omitido el estudio de balance entre los beneficios socio económicos y los costos ambientales. A esto se abona que al aquí imputado le correspondía preparar el Decreto para presentarlo al Presidente; Que el Decreto se enmarca dentro del Plan Nacional del Desarrollo, por lo que hubo "presión política" para que el proyecto se concretara; y, se destaca que se tramitó en tiempo muy corto, refiriéndose a la emisión del Decreto y el otorgamiento del permiso de corta de los árboles por parte del SINAC (mediante la resolución número 244-2008-SCH). Con respecto a esta forma de sustentar la solicitud de condena en contra del aquí imputado, lo primero que salta a la vista es que no hay una correspondencia clara con la premisa de la intimación de la acusación, pues aquí lo que se indica es que se emitió el Decreto sin que el proyecto minero Crucitas reuniera las condiciones legales para ser declarado de conveniencia nacional, contrariando los artículos 3 inciso m), 19 inciso b) y 34 de la Ley Forestal.

Para una mejor claridad, sí es importante conocer el contenido del Decreto Ejecutivo número 34801-MINAET, publicado en La Gaceta número 201, del 17 de octubre de dos mil ocho, expresamente y en lo conducente dispone que:

"VII. El proyecto Crucitas traerá varios beneficios económicos a la comunidad de San Carlos y el gobierno central. Entre estos beneficios están los siguientes: i) La mina tendrá una operación cercana a los 11 años (incluye construcción, operación y cierre técnico). Esto significa que durante ese tiempo habrá desarrollo de las comunidades cercanas a Crucitas y necesidad de mano de obra; ii)La inversión inicial para construir la mina Crucitas es cercana a US$65.000.000. Se calcula que gran parte de ese monto se usará para compra de servicios profesionales, pago de contratistas, compra de materiales y maquinaria; muchos de estos adquiridos en la zona de San Carlos; iii)Se estima que dará empleo a 253 personas directas. En minería se calcula que por cada empleado directo, se da empleo a 5 empleados indirectos; por lo que tendremos 1.265 empleados indirectos; iv)Dentro de los compromisos sociales se procurará que al menos el 75 % de los empleados sean de la zona cercana a Crucitas; v)Planilla: La planilla anual para pagar a los empleados se estima en US$4.132.859; vi)Impuesto local: El Código de minería establece que las empresas mineras deberán pagar al 2% de su utilidad bruta a la comunidad; por lo que la Municipalidad de San Carlos y la comunidad del área de influencia a Crucitas recibiría anualmente un aproximado de US$1,441.158 durante ocho años (para un total de US$11.529.263); vii)Se maneja un fideicomiso para desarrollar obras sociales y las acciones de la comisión de monitoreo del Proyecto Crucitas, que recibiría anualmente la suma de US$364.063 y viii)El proyecto Crucitas pagará impuestos al gobierno central, se tiene calculado un pago anual por impuesto de renta de US$8.790.289 para un total por la vida de la mina de US$70.322.309.

VIII.-Para la construcción y desarrollo del Proyecto Crucitas se requiere la corta de árboles en 191 Ha 7782,66 m2 que poseen bosque, lo cual representa el 19.93% del bosque existente en todas las propiedades, la corta de los árboles en 66 Ha 9474,53m2 en áreas de uso agropecuario sin bosque, lo cual representa el 14% de las áreas de uso agropecuario sin bosque existente en todas las propiedades y la corta de árboles de 4Ha 1 751.38m2 que poseen plantaciones forestales, lo cual representa el 12.33% de las plantaciones forestales existentes en todas las propiedades. Dentro de las especies forestales de la zona, se presentan algunas vedadas, de acuerdo con el Voto de la Sala Constitucional N° 2486 de las 10 horas 54 minutos del 8 de marzo de 2002 y el Decreto Ejecutivo N°25700 del quince de noviembre de 1996. IX. Como compensación por el cambio de uso, Industrias Infinito, S.A. propuso las siguientes medidas de compensación: i)Apoyo para la compra de un terreno para conservación por un monto de doscientos cincuenta mil dólares; ii)La siembra de 49.8 árboles por cada árbol que se requiera cortar y iii)La creación y conservación de un corredor biológico dentro de sus propiedades. Por tanto,

DECRETAN

DECLARATORIA DE INTERÉS PÚBLICO Y CONVENIENCIA NACIONAL DEL PROYECTO MINERO CRUCITAS Artículo 1°-Se declara de interés público y conveniencia nacional el Proyecto Minero Crucitas desarrollado por la empresa Industrias Infinito, S.A.

Artículo 2°-En virtud de la presente declaratoria, la empresa desarrolladora, previa autorización de la oficina correspondiente del Sistema Nacional de Áreas de Conservación, podrá proceder a la corta de árboles (inclusive de las especies que estén vedadas) y al desarrollo de las obras de infraestructura en áreas de protección, según se indica en el proyecto. (...)".

Con respecto a la supuesta presión política, no hay ningún elemento de convicción recibido en el contradictorio que dé cuenta que se diera una presión indebida por parte del aquí imputado o de algún jerarca con respecto al trámite que se le dio a la concesión minera como un todo unitario, en ninguna fase, ante ninguna dependencia y ningún funcionario público da cuenta que haya recibido algún tipo de presión incorrecta para resolver en sentido de favorecer a la empresa Industrias Infinito, por ello este argumento es especulativo y sin sustento alguno. Con respecto a que estaba contemplado en el Plan Nacional de Desarrollo el impulso que el gobierno le iba dar a la actividad minera, eso no era algo oculto, se manejó con total transparencia y de todas maneras en el Código de Minería, la actividad minera era considerada de interés nacional, por lo tanto, los fines declarados en la Ley tenía que de alguna manera materializarse por parte de los gestores de la política pública.

Sobre el corto tiempo que menciona el señor fiscal, esta afirmación presenta un sesgo importante, ya que desconoce que la empresa Industrias Infinito había iniciado los trámites para obtener la concesión minera muchos años atrás y tuvo marchas y retromarchas por las situaciones que se fueron presentando en el devenir y nada más como ejemplo, por estar muy próximo a la publicación del Decreto, se infiere del oficio número SG-ASA-259-2008, del diez de octubre de 2008, que la SETENA comunicó al Departamento de Auditoría y Seguimiento Ambiental, que la evaluación para determinar el balance del costo ambiental en relación con los beneficios socio-económicos del proyecto se realizó ante la SETENA en un plazo de tres años. De la lectura de los considerandos que se enlistan en el Decreto en cuestión, no logra inferir el Tribunal algo que pueda ser tachado de falso, por el contrario, lo que se aprecia más bien es que la Administración -concretamente el encartado en su calidad de Ministro y el Presidente de la República-, al momento de emitir el Decreto, tenían claro que el proyecto sí iba impactar el ambiente, es decir, sí iba tener costos ambientales, pero de acuerdo con lo que es le presentó por parte de las Dependencias administrativas que se ocuparon de valorar estos temas, por ser técnicos y jurídicos, también iba a generar empleo en la zona de Crucitas, dinero al Estado y a la Municipalidad, entre otros.

Aquí, no hay que perder de vista que tratándose de derecho ambiental, entendido como un sistema complejo, como conjunto de normas y principios, nacionales y de derecho internacional, que regulan y orientan las relaciones entre el ser humano y su entorno natural y urbano, buscan también la finalidad de alcanzar un equilibrio que permita la satisfacción de las necesidades humanas a través de procesos sociales, productivos y culturales, resguardando la integridad y conservación de la biodiversidad, es por esto que en todo este proceso en que aparece como fruto el Decreto de Conveniencia, se involucraron los órganos de Gestión ambiental y se valoraron los distintos elementos y los resultados de la evaluación, primero ante la Dirección de Geología y Minas para el otorgamiento de la concesión tanto de la exploración como en su momento de la concesión para explotación, y luego ante la SETENA, para obtener la viabilidad ambiental, la participación que tuvo la Dirección Jurídica del MINAET, del Departamento de Leyes y Decretos de Casa Presidencial, y por supuesto, la abogada del Despacho del Ministro [Nombre 001], que revisaron las actuaciones, y el Decreto y sólo cuando se consideró que estaba listo para ser firmado y publicado, así se procedió, en esto no hay ninguna conducta intencionada encaminada a infringir el Ordenamiento Jurídico.

Pese a lo que resolvió el Tribunal Contencioso sobre los vicios detectados en el Decreto de Conveniencia Nacional, tenemos que cosa muy distinta es, sostener en esta sede que el aquí imputado [Nombre 001] actuó dolosamente, es decir, con conocimiento y voluntad. El Tribunal Contencioso ya definió la forma en que debía establecerse el estudio que se menciona en la Ley Forestal, pero para los efectos de lo que nos ha correspondido determinar, lo que se tiene es que el Decreto al menos cumple con mencionar y exponer lo que en ese momento se tenía como beneficios que iba generar el proyecto, los costos ambientales -que no necesariamente comportan daños ambientales- y la forma en que iban a ser de alguna manera compensados, por lo que desde el punto de vista penal, no puede ser configurativo del delito de Prevaricato, ya que para definir sus alcances se tuvo que apreciar lo que la Ley Forestal, la que no define de forma clara el tema, por lo que hubo por parte de los funcionarios, un margen de interpretación de la Ley y esto excluye la posibilidad la adecuación típica.

No está demás hacer ver que conforme a los principios que rigen para una correcta argumentación, cuando la conclusión se sigue de las premisas, para obtener una conclusión segura, hay que tener presente que un argumento no es en sí mismo una afirmación, sino un conjunto o serie de afirmaciones con la característica de que unas se siguen a otras, un intento de apoyar ciertas opiniones con razones; dar un argumento significa ofrecer un conjunto de razones o de pruebas en apoyo de una conclusión. De esta manera, las premisas o conclusiones en sí podrán ser verdaderas o falsas, pero ello no impacta sobre la calificación del argumento. Un argumento puede ser válido o inválido, correcto o incorrecto, pero no verdadero o falso, cualidad que solo puede predicarse respecto de las premisas o conclusiones. Será válido o correcto si las premisas apoyan efectivamente la conclusión y será inválido o incorrecto en el caso contrario. Así es como este Tribunal penal aprecia la emisión del Decreto, solo de esta manera es posible incardinar la conducta atribuida al encartado [Nombre 001] en el precepto penal que se le ha atribuido.

Del contenido de las actuaciones, de la prueba y demás probanzas analizadas, en todo esto de la concesión minera a Industrias Infinito vemos que hubo intervención de varios órganos administrativos, se vertieron varios criterios -incluso contradictorios entre los Departamentos legales del mismo Ministerio de Ambiente-, la cantidad de abogados intervinientes durante el procedimiento administrativo y para más ahínco, tenemos que la Sala Constitucional resolvió algunos temas con respecto a la Concesión minera en cuestión. Es oportuno tener presente que la Sala Constitucional en el Voto mencionado por el aquí imputado, fue clara al señalar también que: "no resulta necesario que en el mismo decreto se haga constar de manera expresa toda la valoración efectuada, los instrumentos aplicados, la metodología utilizada, o los puntajes obtenidos y asignados en cada ítem, aspectos que sí deben cumplirse en sede administrativa pero sin que sea necesario realizar una transcripción de toda la evaluación en el cuerpo del decreto, pues para los efectos de la fundamentación del instrumento normativo basta con referir la realización del procedimiento de evaluación del balance, explicar cuáles son los costos y cuáles son los beneficios a obtener, es decir, que el decreto demuestre con datos concretos y exactos que la evaluación sí fue realizada..." (Cfr. sentencia 4399-2010, de la Sala Constitucional).

Esto lo dice el más alto Tribunal de la República, cómo entonces venir a sostener que el imputado [Nombre 001] haya actuado dolosamente al firmar el Decreto que se afirma adolecía del "instrumento de valoración y medición", lo expuesto exime en realidad de cualquier comentario, ya que queda evidenciado que como tal, el Decreto en la forma que se le presentó para ser firmado, cumplía objetivamente con lo que el encartado podría asimilar como válido, correcto y legal y con respecto a lo que la Sala puntualiza, tenemos también que la intimación de la acusación no va en ese sentido. Aunque el tema en realidad es complejo de exponer acá, sí debe reflexionarse sobre las discusiones que se han dado y que cobran sentido acá, con respecto a la concepción del derecho penal como tecnología social, al respecto el debate entre Jürgen Habermas y Niklas Luhmann, lo que originó una intensa polémica y en el que han tomado partido varios autores de renombre mundial.

En definitiva, puede concluirse que en el marco de una tecnología social, la verdad sirve al mantenimiento del orden existente, sirviendo como medio de reducción de la complejidad del entorno y como garantía de invariabilidad, transfriendo seguridad sobre la base de una generalización empírica del reconocimiento que se le preste a una tesis determinada. No hay entonces posibilidad alguna de considerar doloso el comportamiento del imputado [Nombre 001], pues en medio de ese piélago normativo se dieron las valoraciones e interpretaciones por parte de los encartados, con prescindencia de que el Tribunal Contencioso -desde su atalaya de contralor de legalidad- , resolviera después que dichas actuaciones, resoluciones y decretos eran contrarias a derecho. Corolario de lo anterior, en este proceso penal no se acreditó que el actuar de los imputados fuera deliberado, tenemos ausencia del elemento cognoscitivo del dolo del tipo penal de Prevaricato, aunado a la imposibilidad de visualizar el elemento volitivo de querer dictar una resolución en contra de la ley y de los deberes de la Función Pública.

Los acusadores tenían que demostrar el conocimiento cierto o al menos potencial de los elementos objetivos del tipo penal del Prevaricato, además de la voluntad de realizarlo con ese conocimiento; estos elementos no se observan en el presente caso sometido al escrutinio de esta integración del Tribunal. No puede negarse o descartarse que las infracciones al Ordenamiento Jurídico que fueron constatadas y puestas de manifiesto por el Tribunal Contencioso Administrativo hayan obedecido a falencia, desconocimiento o simple error por parte de los imputados, pero para los efectos que aquí interesan, tenemos que no se acreditó que ello se debió a un actuar deliberado en el accionar de los acriminados, esto por cuanto existe un innegable margen de apreciación cuando se procede a aplicar la ley a un caso concreto, cuando se definen sus alcances, al darle sentido, interpretar lo que ella establece para una generalidad de casos y en esto hay que tener presente siempre que el Ordenamiento Jurídico es un todo sistemático, pero también bajo la consideración de que es un sistema, que de acuerdo con los más reconocidos autores, nunca habrá de considerarse como algo definitivo y acabado -lo cual resulta lógico-, sino siempre como algo susceptible de modificación y de nueva armonización cuando sea preciso incorporar a el nuevos principios de enfrentamiento con nuevos problemas.

Por las razones dichas, se absuelve al aquí encartado [Nombre 001] por los dos delitos de Prevaricato que se le venían atribuyendo, como cometidos en daño de los Deberes de la Función Pública.» (sic, Sentencia, págs. 160 a 174).

Luego, el tribunal penal examina en concreto el caso de los coimputados [Nombre 002], [Nombre 003], [Nombre 004] y [Nombre 005], entre las páginas 175 y a 188; respecto a la acusada [Nombre 009], entre las páginas 216 a 219 de la sentencia; y en cuanto a la encartada [Nombre 006], entre las páginas 219 a 222. Respecto a esta última, llama la atención de este Tribunal de Apelación que en las acusaciones se atribuyó a la señora [Nombre 006] haber actuado como cómplice del acusado [Nombre 001] (respecto al delito relacionado al dictado del Decreto Ejecutivo 34801-MINAE), sin embargo el propio Ministerio Público solicitó que se dictara una sentencia absolutoria en favor de aquella, petición que atendió el tribunal penal, señalando que "la investigación no arrojó prueba testimonial o documental que estableciera ni por sospecha, vínculo alguno entre [Nombre 001] y [Nombre 006], por lo que resulta imposible atribuir una vinculación como cómplice de esta última por los actos ilegales atribuidos a [Nombre 001]" (cfr.

Sentencia, págs. 219 a 222). Así las cosas, concluye el tribunal penal, se absuelve de toda pena y responsabilidad: a) al imputado [Nombre 001] por los hechos acusados y querellados, calificados como constitutivos de dos delitos de prevaricato en perjuicio de los deberes de la función pública; b) a las imputadas [Nombre 006] y [Nombre 009] por los hechos acusados en calidad de cómplices de [Nombre 001] para la comisión del delito de prevaricato; c) a los imputados [Nombre 002], [Nombre 003], [Nombre 004] y [Nombre 005], por los hechos acusados como configurativos de un delito de prevaricato en daño de los deberes de la función pública.

Por otra parte, los recurrentes sostienen que de la prueba examinada se derivan indicios que permiten considerar que el imputado [Nombre 001] sí actuó dolosamente; y, además, que el tribunal penal arbitrariamente excluyó prueba testimonial que pudo ser esencial para comprobar el dolo, aludiendo concretamente a los testigos [Nombre 010], [Nombre 011] y [Nombre 012], quienes se abstuvieron de declarar con ocasión de que el tribunal penal, ante el criterio de la defensa técnica de los imputados, consideró que se trata de testigos sospechosos. Ambos apelantes alegan que determinar la existencia de una autoincriminación solo es posible a partir de lo que declaren los testigos y no de forma anticipada a su declaración, por lo que sostienen que el tribunal penal adelantó criterio al considerar que eran testigos sospechosos, antes de que estos dieran su testimonio en juicio, sin que existiera ningún elemento para que el tribunal de juicio estimara que el interrogatorio de estos testigos los pudiera incriminar.

Estos reparos no son atendibles. A criterio de este Tribunal de Apelación de Sentencia Penal, no hay razón alguna por la cual se deba considerar que el motivo para sospechar de la participación de una persona en la comisión de un determinado hecho delictivo, tiene que surgir necesariamente de lo que esta persona declare en juicio como testigo, sino que el motivo de sospecha también puede derivar de otras fuentes diferentes, como sucedió en el presente caso, en vista de que los testigos [Nombre 010], [Nombre 011] y [Nombre 012] quienes optaron por abstenerse de declarar, en condición de testigos sospechosos, porque haber sido funcionarios que intervinieron y suscribieron parte de los actos o resoluciones que el Ministerio Público describe en la acusación, que fueron declarados ilegales por el Tribunal Contencioso Administrativo (cfr. Sentencia, págs. 100 a 101), por lo que no resultó arbitraria la decisión del tribunal, sino ajustada a los lineamientos de la citada jurisprudencia constitucional.

En el artículo 204 párrafo primero del Código Penal se dispone con claridad que el "El testigo no estará en la obligación de declarar sobre hechos que puedan depararle responsabilidad penal" y la jurisprudencia de Sala Constitucional advierte que "el testigo sospechoso podrá abstenerse de indicar todo aquello que pueda implicarle responsabilidad penal y el juez de la causa deberá valorar esta circunstancia en el caso concreto, advertirle las consecuencias de su dicho y que le asiste el derecho al silencio. La declaración recibida en contravención con lo anterior, no podrá surtir efectos y será absolutamente nula por violación a los principio que integran el debido proceso. Por otra parte, nada impide al juez permitir al testigo sospechoso que se haga asesorar de un letrado a efecto de que pueda enterarse de cuáles manifestaciones pueden implicarle responsabilidad penal." (Sala Constitucional N° 5630 de las 16:06 horas del 28 de setiembre de 1994, reiterada en la N° 8733 de las 8:30 horas del 13 de agosto de 2004).

Adicionalmente, ninguno de estos tres testigos sería determinante para la decisión del caso, pues ninguno fue ofrecido para demostrar que el imputado [Nombre 001] actuó dolosamente al firmar el Decreto Ejecutivo 34801-MINAE. En cuanto al examen y valoración de los testigos que sí declararon en juicio (particularmente de las declaraciones de [Nombre 014], [Nombre 018] y [Nombre 015]) y de la prueba documental, tampoco resulta atendible la tesis de que estos arrojan indicios que permiten tener seguridad de que el encartado actuó dolosamente, cuestión que fue resuelta con amplitud por el tribunal de juicio, al advertir que los indicios que plantean los acusadores no son precisos sino que carecen de idoneidad suficiente para tener certeza de que el acusado [Nombre 001] haya actuado con el conocimiento y voluntad (dolo) que requiere el tipo penal de prevaricato, ya que él no es la persona que redactó el texto del Decreto Ejecutivo 34801-MINAE (lo redactó un departamento legal), él no fue advertido de que este acto pudiera ser ilegal, sino que lo firmó porque traía visto bueno del departamento legal del ministerio.

En la página 187 de la sentencia, hace notar el tribunal penal que, durante el procedimiento contencioso administrativo, la Procuraduría General de la República más bien defendió la legalidad de las resoluciones dadas por la Administración Pública, lo que evidencia que no se trata de un tema sencillo establecer si los decretos indicados en la acusación (particularmente el 34801-MINAE) estaban o no conformes con el ordenamiento jurídico costarricense.

Conforme a lo expuesto, no se observa ningún defecto que determine la ineficacia de la sentencia que absolvió al imputado [Nombre 001] por un delito de prevaricato en relación al dictado del Decreto Ejecutivo 34801-MINAE, por lo que se declaran sin lugar los recursos de apelación de sentencia interpuestos por el Ministerio Público y la Procuraduría General de la República.

POR TANTO:

Se declaran sin lugar los recursos de apelación de sentencia interpuestos por el Ministerio Público y la Procuraduría General de la República.
