CONSIDERING
1. By means of a filing dated 14 de junio de 2024, PARQUE INDUSTRIAL JATEO S.A. instituted a merits proceeding (proceso de conocimiento) with a request for interim relief against MUNICIPALIDAD DE MORA and ANOTHER PARTY.
As developed by the Sala Constitucional, interim judicial protection (justicia cautelar) responds to the need to guarantee the constitutional principle of prompt and effective justice by preserving the factual conditions essential for rendering and enforcing the judgment (Resolución 7190-1994, at 15:24 on 6 de diciembre). In this same regard, article 19 of the CPCA establishes that the purpose of ordering interim relief is to provisionally protect and safeguard the subject matter of the proceeding and the effectiveness of the judgment. Legal scholarship has indicated that interim judicial protection is not intended to declare a fact or liability, establish a legal relationship, enforce an order and satisfy an undisputed right, or resolve a dispute, but rather to prevent harm that the litigation may cause or that may arise from an abnormal situation (Gallegos Fedriani, Pablo. Las medidas cautelares contra la Administración Pública. 2 ed.
Buenos Aires, Argentina: Ábaco, 2006). Pursuant to article 21 of the CPCA, when determining whether a request for interim relief should be granted, the judge must verify that the claim asserted in the merits proceeding is neither frivolous nor manifestly lacking in seriousness. This constitutes a preliminary assessment of the merits to determine whether the case presents what legal scholarship and case law have called a likelihood of success on the merits (apariencia de buen derecho or fumus boni iuris). Furthermore, that same article 21 of the Code provides that interim relief is appropriate when the implementation or continuation of the conduct under review causes serious actual or potential harm or loss, a situation defined in legal scholarship as risk arising from delay (peligro en la demora or periculum in mora); that is, when the undue delay inherent in judicial proceedings creates a present, real, and objective risk that the moving party will suffer serious harm (Jinesta Lobo, Ernesto.
Manual del Proceso Contencioso-Administrativo. 1 ed. San José, Costa Rica, Editorial Jurídica Continental, 2008). Lastly, article 22 of the CPCA requires the judge, in light of the principle of proportionality, to balance the interests at stake: the private party’s circumstances, on the one hand, and the public interest and the interests of third parties that may be affected by the granting of interim relief, on the other. Only when all three elements are present—namely, a likelihood of success on the merits, risk arising from delay, and a determination, based on the balancing of interests (ponderación de intereses), that the harm suffered by the private party warrants protection over the other interests at stake—may the Court grant the requested interim relief.
III.CLAIMS AND ARGUMENTS OF THE MOVING AND RESPONDENT PARTIES AND ANALYSIS OF THE SPECIFIC CASE.- The purpose of this application for affirmative interim relief (solicitud cautelar de carácter positivo) is to compel the Municipalidad de Mora to grant the stormwater discharge authorization (autorización de desfogue pluvial) requested by Parque Industrial Jateo S.A., given that no circumstances exist that would prevent runoff (escorrentía) from being discharged into the streams adjacent to the waste recovery technology center (centro tecnológico de valorización de residuos), this being a measure required to protect the public interest. (image 48). Subsequently, the party breaks down its application for interim relief into one principal claim and three ancillary claims, as follows: “Principal claim: That the effects of the Reglamento del Servicio Público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos issued by the Municipalidad de Mora be immediately stayed.
And, in turn, that said Municipality be ordered to provisionally grant the claimant the stormwater discharge authorization required for the development of Parque Industrial Jateo. Ancillary claim 1: That authorization be granted to continue the proceedings before the different Public Administrations having jurisdiction over any aspect of the project, as well as to commence construction of Parque Industrial Jateo. Ancillary claim 2: That the respondent Municipality be ordered to provide sufficient security (garantía) to cover damages, lost opportunity, interest, and costs in the event of a possible final judgment granting the complaint. Ancillary claim 3: That the Municipalidad de Mora be compelled to decide on the merits, with respect to both legal and technical aspects, the stormwater discharge application processed by the claimant and, within a reasonable period, to issue the appropriate ruling under the law” (images 57 to 58).
The moving party, Parque Industrial Jateo S.A., states that it owns the property in the province of San José, registration number 568922, located in Picagres de Mora, measuring 237 hectares according to registered cadastral survey SJ-0992578-2005, on which it is processing the construction of an industrial complex for the treatment and recovery of waste generated by the Gran Área Metropolitana. (Documentary evidence 1). That on 22 de noviembre de 2004, the Instituto Nacional de Vivienda y Urbanismo issued resolution PU-C-AT-2849-A-2004, certifying that the land use (uso de suelo) for Parque Industrial Jateo was compatible with the location of the property to be developed, following a request by the Municipalidad de Mora (Documentary evidence 2 and 17). That on 20 de abril de 2005, the Ministerio de Salud, through resolution DPAH-2250-PCU- 298-05, approved the siting permit (permiso de ubicación) for the construction of Parque Industrial Jateo S.A. (Documentary evidence 3).
That on 18 de junio de 2012, through official letter UGA-OF-014-2012, signed by the coordinator of the Unidad de Gestión Ambiental of the Municipalidad de Mora, Ms. Gretel Agüero Alfaro, she forwarded to the Alcaldía Municipal the technical proposal for the Reglamento del Servicio Público para la gestión Integral y aprovechamiento de los residuos sólidos del Cantón de Mora. (Documentary evidence 13, folio 107). That on 16 de abril de 2013, the draft Reglamento del Servicio Público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos was published for public consultation in La Gaceta no. 72. (Documentary evidence 13, folio 181). That on 29 de mayo de 2013, the Secretaría Técnica Nacional Ambiental issued resolution 1423-2013-SETENA, in which it approved the environmental viability (viabilidad ambiental) requested by the claimant for the development of Parque Industrial Jateo, which provided for a period of two years to commence construction once the resolution became final.
(Documentary evidence 4). That on miércoles 26 de junio de 2013, an edict of the Municipalidad de Mora was published in La Gaceta No. 122, announcing that no objections had been submitted to the proposed Reglamento del Servicio Público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos; said edict stated: it is hereby finally approved and shall enter into force upon this publication. (Documentary evidence 5, image 58). That on 5 de agosto de 2015, the Ministro de Ambiente y Energía issued Resolution R-231- 2015-MINAE, which denied the last of the appeals filed against the approval of the environmental viability issued by SETENA in resolution 1423-2013- SETENA, thereby commencing the two-year period for the start of construction. (Documentary evidence 6). That on 6 de octubre de 2016, my client submitted to the Municipalidad de Mora a request for information regarding the procedures to be followed to obtain the road alignment (alineamiento vial) and stormwater discharge authorization, steps necessary to obtain the CFIA Plan Approval (Visado de Planos).
(Documentary evidence 7). That on 7 de diciembre de 2016, the Municipalidad de Mora issued Resolution AMM-603- 2016, in which the Acting Mayor assumed jurisdiction over the request for information submitted by the claimant and denied it. (Documentary evidence 8). That between diciembre de 2016 and mayo de 2017, the claimant formally processed the application for stormwater discharge authorization and the corresponding road alignment for property 1-568922. (Documentary evidence 9). That on 26 de mayo de 2017, through resolution DDCU-006-2017, the Municipalidad de Mora, acting through Mr. Wilbur Arce Mora, denied the stormwater discharge application referred to in the preceding fact, which my client challenged through an appeal before the non-hierarchical appellate authority (jerarca impropio). (Documentary Evidence 9). That on 5 de junio de 2017, SETENA issued resolution 1105-2017, in which it suspended the two-year period initially granted for the commencement of construction because it was impossible to obtain CFIA approval of the plans until the discharge proceedings before the Municipalidad de Mora were concluded.
(Documentary Evidence 11). That on 17 de mayo de 2018, the claimant submitted to the respondent Municipality the application for stormwater discharge authorization and road alignment for the Parque Industrial Jateo project. (Documentary evidence 12). That on 20 de setiembre de 2022, the Dirección de Agua del Ministerio de Ambiente y Energía issued Resolution DA-1338-2022, granting the claimant the permit to discharge wastewater generated by Parque Industrial Jateo. (Documentary evidence 15). That on 13 de setiembre de 2023, the Tribunal Contencioso Administrativo, acting as the two-stage non-hierarchical appellate authority (jerarca impropio bifásico), issued resolution 2023003305, denying the appeal filed by the claimant’s representative against resolution AMR-047-2020. (Documentary evidence 16). Regarding the prerequisites for interim measures (medidas cautelares), the claimant argues as to LIKELIHOOD OF SUCCESS ON THE MERITS (APARIENCIA DE BUEN DERECHO): In the specific case, the seriousness of the complaint filed is evident, the claimant argues, since the stormwater discharge permit was denied by the Municipalidad de Mora in open contradiction of the body of applicable law (bloque de legalidad), through the improper application of an invalid and ineffective regulation and in contravention of the prior authorizations granted by the governing bodies in matters of health, the environment, and urban planning, thereby rendering the authority of those bodies ineffective.
Regarding PERICULUM IN MORA: Section 21 of the CPCA refers to this prerequisite by stating that “the interim measure shall be appropriate when the execution or continuation of the conduct at issue in the proceedings causes serious present or potential damage or harm to the situation asserted (…)”. Thus, the requirement of danger in delay (peligro en la demora) is closely linked to the existence of present or imminent harm, since the very purpose of interim relief is to mitigate or prevent such harm. In this matter, it states, periculum in mora exists, making it imperative that the interim measure be granted, as this would prevent severe harm to public health and the environment and prevent further harm to the claimant. As shown by technical study MS-DPRSA-USA-0180-2024 (documentary evidence 18), prepared by the Ministerio de Salud, the few authorized sanitary landfills (rellenos sanitarios) currently operating in the GAM are nearing the end of their useful life, which implies an impending waste crisis.
The solid-waste final disposal site (sitio de disposición final de residuos sólidos) located in La Carpio, which receives the vast majority of the waste generated in this region, has reached critical accumulation levels indicating that it will be completely saturated within no more than 5 to 7 months. Meanwhile, the Los Pinos landfill has already ceased operations. This places substantial pressure on the El Huazo-Aczerrí sanitary landfill (which currently receives waste from the Los Pinos sanitary landfill), since it would absorb all waste previously distributed among 3 sanitary landfills (La Carpio, Los Pinos, Los mangos), considerably reducing its remaining useful life and particularly affecting the communities adjacent to that landfill, which are located one street away. (See documentary evidence 18 in this regard). Additionally, granting this interim measure would help mitigate the worsening of the damage and harm suffered by the claimant, since it has made substantial investments and efforts to develop an innovative project that fully complies with all technical and legal requirements imposed by the legal system.
BALANCING OF INTERESTS (PONDERACIÓN DE INTERESES): The requested interim measure not only does not harm the public interest, but in fact safeguards it to the greatest extent by providing preventive protection for public health. After being afforded the hearing required by law, the MUNICIPALIDAD DE MORA addressed the authority granted by statute N° 8839, Ley Para la Gestión Integral de Residuos, section 8, subsection B of which provides as follows: “(…) ARTICLE 8.- Functions of municipalities: Municipalities shall be responsible for the integrated management (gestión integral) of waste generated in their canton; for that purpose, they shall: b) Issue regulations within the canton for the classification, separate collection, and final disposal of waste, which shall be consistent with the objectives of this Law and its Regulations. (…)” (Emphasis added). The Municipality continues by stating that, accordingly, it can be seen that the Municipalidad de Mora has at all times acted under the principle of legality (principio de legalidad) and is therefore exercising the functions conferred upon it by the aforementioned statute.
In addition, the Procuraduría General de la República itself has indicated that municipalities are legally empowered to issue regulations governing waste, through opinion N° C-066-2016 dated 04 de abril de 2016, from which the following is excerpted: “(…) Consequently, it is not that municipalities are barred from issuing regulations in this area; rather, their content must be limited to the matters authorized by law. With regard to the integrated management of waste and the operation of sanitary landfills or industrial plants, municipalities must comply with the national regulations issued by the Poder Ejecutivo as part of the Política Nacional and the Plan Nacional de Gestión Integral de Residuos; therefore, if they issue regulations in this area, those regulations must be subject to the guidelines established in such national provisions.
(…)” Regarding the risk arising from delay (peligro en la demora): It is important for this Administration to emphasize that the project the plaintiff seeks to develop, which consists of establishing a sanitary landfill (relleno sanitario), entails a wide range of environmental variables that must be analyzed, because it is necessary to conduct or update a detailed technical analysis whose ultimate and primary purpose is to protect the environment and public health, thereby preventing potential environmental harm that, by its very nature, could not be reversed. Regarding the balancing of interests (ponderación de intereses): It must be taken into account that the Regulations Governing the Public Service for the Integrated Management and Recovery of Solid Waste of the Canton of Mora (Reglamento del servicio público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos del Cantón de Mora) regulate a broad range of matters, such as educational projects; policies concerning the storage, classification, and separation of waste; waste recovery; waste transportation; collection centers; various recycling matters; statistical records; collection services; the cleaning of roads and public places; prohibitions; fines; and penalties.
These are all matters over which the Municipality has authority pursuant to the body of law (bloque de legalidad) set forth herein, without those functions or that municipal regulatory instrument itself encroaching upon the powers vested by law in the Ministerio de Salud. Finally, the Municipality states that, of all the forms of relief sought by the plaintiff, it is important to note that the second claim, concerning the provision of security (garantía) by this Municipality, is wholly disproportionate, since it could have an extremely serious impact on the finances of the Municipalidad de Mora, thereby affecting various programs and services provided by that institution for the benefit of all persons having some connection with the canton of Mora. It is therefore necessary to weigh that measure, insofar as it would seriously impair the common good pursued by this Local Government for the benefit of the entire population and would also result in noncompliance with Article 170 of the Constitución Política concerning the functions that Municipalities must perform and fulfill.
This Court should also take into account that, as already stated herein, the Regulations Governing the Public Service for the Integrated Management and Recovery of Solid Waste of the Canton of Mora regulate numerous core matters and aspects necessary for the proper functioning of this corporation and the services offered to the community. Therefore, should it be deemed appropriate to grant the interim measure (medida cautelar) requested by the plaintiff herein, it would be advisable not to suspend the municipal regulation in its entirety; accordingly, should this Court see fit, it should suspend only Transitional Provision II (transitorio II) of that regulatory instrument, which has served as the legal basis for addressing the applications submitted to this Local Government in connection with the sanitary landfill project. For her part, co-defendant GRETEL AGUERO ALFARO stated, in response to the hearing granted, that the requested interim measure consists of compelling the Municipalidad de Mora to suspend the effects of the Regulations Governing the Public Service for the Integrated Management and Recovery of Solid Waste and to grant the stormwater discharge authorization requested by the plaintiff company, among other ancillary interim claims.
The content and scope of those interim claims coincide with substantive claims numbers one and 4 asserted in the complaint, thereby undermining the ancillary nature (instrumentalidad) of interim measures, because granting them at this procedural stage would be equivalent to granting part of the substantive relief sought. With respect to the necessary ancillary nature of interim measures, the case law of the Tribunal Contencioso Administrativo has favored denying applications that entail granting substantive relief through an interim measure. Finally, when analyzing the risk arising from delay, it must not be overlooked that this matter touches upon Public Health and Environmental Protection, issues of the highest constitutional order, since the right to health and the right to a healthy and ecologically balanced environment are two recognized human and fundamental rights, not only under the Costa Rican Carta Magna itself, but also under the International Conventions signed by the country.
In view of that reality, concrete and effective actions are required to mitigate, in some manner, the effects of private activities that may pose a risk to those protected interests. In particular, the precautionary principle (principio precautorio) counsels, as the Sala Constitucional has repeatedly held, that where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, including postponement of the activity in question. This is because, in environmental matters, ex post enforcement is ineffective, since once biologically and socially harmful consequences have occurred, punishment may carry moral significance but is unlikely to compensate for the environmental harm caused. The evidence submitted by the plaintiff itself shows that the sanitary landfill project processed by the plaintiff has been classified as a sanitary landfill in various proceedings, without recovery of the value of the waste; see item of evidence 12, in which the activity is described as a Sanitary Landfill, and not as the plaintiff has asserted, without contemplating waste recovery, and it would therefore perpetuate the considerably more economically profitable practice of simply burying all types of waste, despite the development of technologies that could minimize adverse environmental impacts and incorporate environmental externalities.
According to the studies conducted by the Municipality, installing a sanitary landfill on the property proposed for the project would be even more harmful. Finally, when analyzing the risk arising from delay, it must not be overlooked that this matter touches upon Public Health and Environmental Protection, issues of the highest constitutional order, since the right to health and the right to a healthy and ecologically balanced environment are two recognized human and fundamental rights, not only under the Costa Rican Carta Magna itself, but also under the International Conventions signed by the country. In view of that reality, concrete and effective actions are required to mitigate, in some manner, the effects of private activities that may pose a risk to those protected interests. In particular, the precautionary principle counsels, as the Sala Constitucional has repeatedly held, that where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, including postponement of the activity in question1.
This is because, in environmental matters, ex post enforcement is ineffective, since once biologically and socially harmful consequences have occurred, punishment may carry moral significance but is unlikely to compensate for the environmental harm caused. According to the studies conducted by the Municipality, installing a sanitary landfill on the property proposed for the project would be even more harmful. She therefore requests that the measures sought be denied. THE COURT’S FINDING: Before analyzing the requirements, the Court must assess the ancillary and provisional nature of the measure sought. The ANCILLARY AND PROVISIONAL NATURE of an interim measure consists of seeking to ensure the effectiveness of the judicial ruling in the underlying proceeding; an interim measure cannot be an end in itself and must be connected to the underlying proceeding. In this case, the underlying proceeding seeks a declaration of nullity (nulidad) of decisions issued by the Municipalidad de Mora denying the stormwater discharge permit on the basis of a Municipal Regulation, because the plaintiff considers that there is an “open conflict with the body of law, through the improper application of an invalid and ineffective regulation and in contravention of prior authorizations granted by the governing bodies for health, environmental, and urban-planning matters, thereby rendering the powers of those authorities ineffectual” (an analysis pertaining to the plenary proceeding (proceso de conocimiento), not to this summary proceeding (vía sumaria)).
Based on an analysis of the claims in the plenary proceeding and the interim measures sought, this Court finds that granting the principal or ancillary interim measure sought by the moving party would amount to granting the substantive relief through summary proceedings, namely, obtaining a stormwater discharge permit. The moving party offers a series of grievances intended to establish the illegality of the substantive reasoning on which the Municipality relied to deny the stormwater discharge permit; that is a substantive analysis for the plenary proceeding. It should be noted that the plaintiff’s theory of the case for granting the discharge permit is confined to the illegality of the Reglamento de la Municiplaidad de Mora; thus, granting principal claim or ancillary claim number 1 (“Principal claim: That the effects of the Regulations Governing the Public Service for the Integrated Management and Recovery of Solid Waste issued by the Municipalidad de Mora be suspended immediately.
And that the Municipality, in turn, be ordered provisionally to grant the plaintiff the stormwater discharge authorization required for the development of Parque Industrial Jateo. Ancillary claim 1: That authorization be granted to continue the proceedings before the various Public Administrations having jurisdiction over any aspect of the project, as well as to commence construction of Parque Industrial Jateo.”) would amount to granting, through summary proceedings, a permit whose legal basis depends upon the analysis of the aforementioned Regulation. Furthermore, ancillary claims 2 and 3 are deemed premature and inappropriate in this proceeding, respectively. Based on the foregoing, it is found that the interim claim DOES NOT possess an ancillary or provisional nature, since what is sought is an order compelling the Municipality to grant a stormwater discharge permit. Notwithstanding the foregoing, the analysis of the requirements will be expanded upon should it be deemed appropriate to examine the relief sought.
Although it is true that the litigant (justiciable) may resort to contentious-administrative proceedings (vía contenciosa) to challenge the validity of an administrative decision or regulatory provision that the litigant considers harmful to their rights, pursuant to Articles 49 of the Constitution and 36 and 42 of the CPCA, this jurisdiction may be invoked to challenge administrative actions such as the one at issue here, thereby preliminarily establishing a likelihood of success on the merits (apariencia de buen derecho), provided that, contrary to the view expressed by this judge, the claim is deemed to possess instrumentality (instrumentalidad) and provisionality (provisionalidad). The plaintiff supports the likelihood of success on the merits with the following argument: “Indeed, the Office of the Attorney General of the Republic, the highest technical-legal advisory body of the Public Administration, has repeatedly opined (C-066-2016 and others) that municipalities lack authority to regulate, through regulations, substantive and technical aspects of landfill operations.
That authority is reserved to the Ministry of Health as the governing body. Local regulations may govern only specific matters concerning waste management at the cantonal level, without contravening national regulations and directives or encroaching upon the areas of authority of other entities. Accordingly, the Municipality’s rejection of the stormwater-discharge authorization (desfogue de aguas) is affected by substantive and procedural defects amounting to absolute nullity (nulidad absoluta), essentially because it invokes the Regulations Governing the Public Service for the Comprehensive Management and Recovery of Solid Waste, which encroach upon the authority of the administration having nationwide governing responsibility for health, environmental, and urban-planning matters by preventing the development of waste-treatment projects or, as applicable, landfills throughout the territory of the canton of Mora.
Furthermore, this provision was not definitively published in La Gaceta.” The defendant Municipality, for its part, states that the Regulations Governing the Public Service for the Comprehensive Management and Recovery of Solid Waste of the Canton of Mora regulate a wide range of matters, including educational projects; policies on the storage, classification, and separation of waste; waste recovery; waste transportation; collection centers; various recycling matters; statistical records; collection services; the cleaning of roads and public places; prohibitions; fines; and penalties, all of which are matters that the Municipality is authorized to regulate pursuant to the body of law (bloque de legalidad) set forth herein, without those functions or that municipal regulatory instrument as such encroaching upon the authority vested by law in the Ministry of Health. In this judge’s view, that jurisdictional analysis is a matter to be determined in the proceedings on the merits (proceso de conocimiento).
With respect to PERICULUM IN MORA, it must be recalled that the burden of proving the existence of serious harm or loss, within the meaning of Article 21 of the CPCA, rests with the party seeking relief. Thus, for interim relief (tutela cautelar) to be appropriate, the implementation or continued existence of the administrative conduct submitted for adjudication must cause serious, actual or potential harm or loss to the legal position of the applicant. In this regard, it must be emphasized that merely alleging the existence of serious harm or loss, whether actual or potential, is insufficient; it must be proven. In this specific case, the APPLICANT contends that granting this interim measure (medida cautelar) would help mitigate the worsening of the harm and losses suffered by the plaintiff, since it has made substantial investments and efforts to develop an innovative project that fully complies with all technical and legal requirements imposed by the legal system.
Nevertheless, it does not identify the specific harm, identify the specific investments involved—loans, assets, etc.—or estimate their value; merely alleging them without identifying and estimating them is insufficient. Because the requirement of danger in delay (peligro en la demora) under Article 21 of the CPCA has not been met, the balance should favor the protection of the public interest. Notwithstanding the foregoing, it is important to note that the party bases the need to grant the requested interim relief on the prevention of harm to public health and the environment, given that the other existing landfills are operating at maximum capacity. In this judge’s view, however, because this matter concerns Public Health and Environmental Protection, it involves fundamental rights that must be protected from actions capable of causing irreversible harm, consistent with the Constitutional Chamber’s ruling in Voto número 2024003959.
CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, a las nueve horas treinta minutos del dieciseis de febrero de dos mil veinticuatro, which held with respect to the PRECAUTIONARY PRINCIPLE (PRINCIPIO PRECAUTORIO): “Thus, when faced with a situation requiring application of the precautionary principle, public entities and bodies must refrain from authorizing, approving, or permitting any new application or modification that could reasonably entail a serious risk; they are even required to suspend activities already underway. At the same time, they must efficiently and effectively adopt all measures required to preserve a healthy and ecologically balanced environment.” And with respect to the IN DUBIO PRO NATURA PRINCIPLE (PRINCIPIO IN DUBIO PRO NATURA): “For its part, according to the ‘World Declaration of the International Union for Conservation of Nature (IUCN) on the Environmental Rule of Law,’ the in dubio pro natura principle means that ‘in cases of doubt, all proceedings before courts, administrative bodies, and other decision-makers shall be resolved in a manner that favors environmental protection and conservation, giving preference to the least harmful alternatives.
No action shall be undertaken when its potential adverse effects are disproportionate or excessive in relation to the benefits derived therefrom (see Principle V).’ In this regard, according to the document ‘95 Environmental Legal Principles for Ecologically Sustainable Development’ (approved at the XIX Edition of the Ibero-American Judicial Summit-2018 and by the Full Court in Article XIX of session no. 28-2020 of May 25, 2020), ‘Every person applying environmental rules must always bear in mind the pro natura principle, under which risks shall be avoided, general collective interests shall take precedence over private interests, environmental preservation shall be favored, and, in cases of doubt, the interpretation affording the broadest protection to the environment shall be preferred.’ The in dubio pro natura principle does not depend on the existence of a danger of serious or irreversible harm—as the precautionary principle does—but instead means that whenever there is a risk of adverse effects on the environment, we are required to avoid choosing conduct that may cause environmental harm.” In light of the foregoing, the balance must favor the prevalence of the public interest, and the requested measures must be denied, as is hereby ordered.
Pursuant to the provisions of Article 24 of the Contentious-Administrative Procedural Code (Código Procesal Contencioso Administrativo), the testimonial evidence offered is not considered necessary, since the documentary evidence in the record is sufficient to issue this ruling.
THEREFORE
The present application for a preliminary injunction (medida cautelar), both principal and ancillary, filed by PARQUE INDUSTRIAL JATEO S.A. AGAINST MUNICIPALIDAD DE MORA, is DENIED. CONSIDERANDO
1. Mediante memorial del 14 de junio de 2024 se interpuso proceso de conocimiento con medida cautelar por PARQUE INDUSTRIAL JATEO S.A. CONTRA LA MUNICIPALIDAD DE MORA y OTRO.
Tal y como ha sido desarrollado por la Sala Constitucional, la justicia cautelar responde a la necesidad de garantizar el principio constitucional de una justicia pronta y cumplida, al conservar las condiciones reales indispensables para la emisión y ejecución de la sentencia (Resolución 7190-1994, de las 15:24 horas del 6 de diciembre). En este mismo sentido, el artículo 19 del CPCA establece que el fin de la fijación de una medida cautelar es proteger y garantizar, provisionalmente el objeto del proceso y la efectividad de la sentencia. La doctrina ha indicado que la justicia cautelar no tiene como fin declarar un hecho o una responsabilidad, ni la de constituir una relación jurídica, ni ejecutar un mandato y satisfacer el derecho que se tiene sin ser discutido, ni dirimir un litigio, sino prevenir los daños que el litigio pueda acarrear o que puedan derivarse de una situación anormal (Gallegos Fedriani, Pablo.
Las medidas cautelares contra la Administración Pública. 2 ed. Buenos Aires, Argentina: Ábaco, 2006). De conformidad con el artículo 21 CPCA, el juez, a la hora de determinar la procedencia de una solicitud de medida cautelar, debe verificar que la pretensión del proceso de conocimiento no sea temeraria o, en forma palmaria, carente de seriedad, lo que constituye una valoración preliminar del fondo para determinar si existe en el caso en cuestión lo que la doctrina y la jurisprudencia han llamado apariencia de buen derecho o fumus boni iuris. Por otro lado, el mismo numeral 21 del Código establece la procedencia de la medida cautelar cuando la ejecución o permanencia de la conducta sometida a proceso produzca graves daños o perjuicios, actuales o potenciales, situación que ha sido definida en la doctrina como el periculum en mora o peligro en la demora, es decir, que en virtud de la demora patológica del proceso judicial, concurra un peligro actual, real y objetivo de que se genere a la parte promovente un daño grave (Jinesta Lobo, Ernesto.
Manual del Proceso Contencioso-Administrativo. 1 ed. San José, Costa Rica, Editorial Jurídica Continental, 2008). Por último, el artículo 22 CPCA establece la obligación del juzgador de realizar, a la luz del principio de proporcionalidad, una ponderación de los intereses en juego, es decir, entre la circunstancia del particular, por un lado y el interés público y los intereses de terceros que puedan verse afectados con la adopción de la medida cautelar, por el otro. Sólo en la concurrencia de los tres elementos, es decir, de la apariencia de buen derecho, del peligro en la demora y que del análisis de la ponderación de intereses se considere que daño sufrido por el particular debe tutelarse por encima de los demás intereses en juego, puede proceder el Despacho a conceder la medida cautelar solicitada.
III.PRETENSIÓN Y ARGUMENTOS DE LA PARTE PROMOVENTE Y DEMANDADA Y ANÁLISIS DEL CASO CONCRETO.- El objeto de la presente solicitud cautelar -de carácter positivo- es conminar a la Municipalidad de Mora a otorgar la autorización de desfogue pluvial solicitada por Parque Industrial Jateo S.A., dado que no se verifican supuestos que impidan el vertido de la escorrentía en las quebradas anexas al centro tecnológico de valorización de residuos, siendo una medida requerida para la tutela del interés público. (imagen 48). Posteriormente, la parte desglosa su pretensión cautelar en una principal y tres accesorias como se indica: "Pretensión principal: Se suspendan, de manera inmediata, los efectos del Reglamento del Servicio Público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos dictado por la Municipalidad de Mora. Y a su vez se ordene a dicha Municipalidad otorgar provisionalmente a la actora, la autorización para el desfogue de aguas pluviales requerido para el desarrollo del Parque Industrial Jateo.
Pretensión accesoria 1: Se autorice la continuación de los trámites en las diferentes Administraciones Públicas con competencia en cualquier aspecto del proyecto, y así mismo, el inicio de las obras del Parque Industrial Jateo. Pretensión accesoria 2: Se ordene a la Municipalidad demandada la rendición de una garantía suficiente para cubrir los daños, perjuicios, pérdida del chance, intereses y costas, ante una posible sentencia firme estimatoria de la demanda. Pretensión accesoria 3: Se conmine a la Municipalidad de Mora a conocer por el fondo, tanto en aspectos jurídicos como técnicos la solicitud de desfogue pluvial tramitada por la actora y en un plazo razonable disponga lo correspondiente en derecho" ( imágenes 57 a 58). Manifiesta la parte promovente, Parque Industrial Jateo S.A., que es propietaria de la finca de la provincia de San José, matrícula 568922, ubicada en Picagres de Mora, con una medida de 237 hectáreas según el plano catastrado SJ-0992578-2005, inmueble en el que tramita la construcción de un complejo industrial para el tratamiento y revalorización de los residuos emanados por el Gran Área Metropolitana.
(Prueba documental 1). Que el 22 de noviembre de 2004, el Instituto Nacional de Vivienda y Urbanismo emitió la resolución PU-C-AT-2849-A-2004, certificando la compatibilidad del uso de suelo del Parque Industrial Jateo con la locación del inmueble por desarrollar, ello tras solicitud de la Municipalidad de Mora (Prueba documental 2 y 17). Que el 20 de abril de 2005, el Ministerio de Salud, mediante resolución DPAH-2250-PCU- 298-05 aprobó el permiso de ubicación para la construcción del Parque Industrial Jateo S.A. (Prueba documental 3). Que el 18 de junio de 2012, mediante oficio UGA-OF-014-2012, suscrito por la coordinadora de la Unidad de Gestión Ambiental de la Municipalidad de Mora, señora Gretel Agüero Alfaro, remitió a la Alcaldía Municipal la propuesta técnica del Reglamento del Servicio Público para la gestión Integral y aprovechamiento de los residuos sólidos del Cantón de Mora.
(Prueba documental 13, folio 107). Que el 16 de abril de 2013, en La Gaceta no. 72, se publicó en consulta pública el proyecto del Reglamento del Servicio Público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos. (Prueba documental 13, folio 181). Que el 29 de mayo de 2013, la Secretaría Técnica Nacional Ambiental emitió resolución 1423-2013-SETENA en la que aprobó la viabilidad ambiental solicitada por la actora para el desarrollo del Parque Industrial Jateo, la cual contemplaba un periodo de dos años para el inicio de las obras a partir de su firmeza. (Prueba documental 4). Que el miércoles 26 de junio de 2013, en La Gaceta No. 122, se publicó edicto de la Municipalidad de Mora publicitando que no se presentaron objeciones a la propuesta de Reglamento del Servicio Público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos, dicho edicto indicó: queda el mismo definitivamente aprobado y entra en vigencia a partir de esta publicación.
(Prueba documental 5, imagen 58). Que el 5 de agosto de 2015, el Ministro de Ambiente y Energía emitió la Resolución R-231- 2015-MINAE que declaró sin lugar el último de los recursos interpuestos contra la aprobación de la Viabilidad Ambiental dictada por SETENA en resolución 1423-2013- SETENA, dando inicio al periodo de dos años para el inicio de las obras. (Prueba documental 6). Que el 6 de octubre de 2016, mi representada formuló ante la Municipalidad de Mora una solicitud de información sobre la tramitología a seguir para obtener el alineamiento vial y autorización para desfogue de aguas pluviales, gestiones necesarias para obtener el Visado de Planos del CFIA. (Prueba documental 7). Que el 7 de diciembre de 2016, la Municipalidad de Mora emitió la Resolución AMM-603- 2016, en la cual, la Alcaldesa a.i. avocó el conocimiento de la solicitud de información planteada por la accionante, rechazando tal gestión.
(Prueba documental 8). Que entre diciembre de 2016 y mayo de 2017, la actora gestionó de manera formal la solicitud de autorización de desfogue de aguas pluviales y alineamiento vial correspondiente a la finca 1-568922. (Prueba documental 9). Que el 26 de mayo de 2017, mediante resolución DDCU-006-2017, la Municipalidad de Mora, mediante el señor Wilbur Arce Mora, rechazó la solicitud de desfogue de aguas pluviales indicadas en el hecho anterior, la cual fue impugnada por mi representada hasta la apelación ante el jerarca impropio. (Prueba Documental 9). Que el 5 de junio de 2017, SETENA emitió la resolución 1105-2017, en la que suspendió el plazo de dos años otorgado inicialmente como plazo para inicio de obras producto de la imposibilidad de obtener el visado de planos por parte de CFIA en tanto se finiquita el trámite de desfogue ante la Municipalidad de Mora. (Prueba Documental 11). Que el 17 de mayo de 2018, la actora presentó ante la municipalidad accionada la autorización para desfogue de aguas pluviales y alineamiento vial en el proyecto Parque Industrial Jateo.
(Prueba documental 12). Que el 20 de setiembre de 2022, la Dirección de Agua del Ministerio de Ambiente y Energía emitió la Resolución DA-1338-2022, que otorgó a la actora el permiso de vertido de aguas residuales generadas por Parque Industrial Jateo. (Prueba documental 15). Que el 13 de setiembre de 2023, el Tribunal Contencioso Administrativo, en calidad de jerarca impropio bifásico, emitió la resolución 2023003305, en la que declaró sin lugar el recurso de apelación interpuesto por el representante de la actora contra la resolución AMR-047-2020. (Prueba documental 16). Sobre los presupuestos de las medidas cautelares argumenta la actora respecto de la APARIENCIA DE BUEN DERECHO: En el caso concreto, la seriedad de la demanda interpuesta es evidente, argumenta el actor, toda vez que el permiso de desfogue pluvial ha sido denegado por la Municipalidad de Mora en abierta contradicción con el bloque de legalidad, mediante la aplicación improcedente de un reglamento inválido e ineficaz, y contraviniendo las autorizaciones previas otorgadas por los órganos rectores en materia de salud, ambiente y urbanismo, haciendo nugatorias las competencias de estas instancias.
Respecto del PERICULUM IN MORA: El numeral 21 del CPCA se refiere a este presupuesto al indicar que “la medida cautelar será procedente cuando la ejecución o permanencia de la conducta sometida a proceso produzca graves daños o perjuicios, actuales o potenciales de la situación aducida (…)”. Así, el requisito del peligro en la demora se encuentra estrechamente vinculado con la existencia del daño actual o inminente, pues el objeto cautelar es precisamente mitigar o evitar que se produzca este. En el presente asunto, manifiesta, se configura el periculum in mora, haciendo imperioso el acogimiento de la medida cautelar, esto permitiría evitar daños severos a la salud pública, el ambiente, e incrementar los perjuicios sobre la accionada. Como se desprende del estudio técnico MS-DPRSA-USA-0180-2024 (prueba documental 18) elaborado por el Ministerio de Salud, los pocos rellenos sanitarios autorizados que operan actualmente en el GAM están próximos a agotar su vida útil, lo implica una crisis de residuos en ciernes.
El sitio de disposición final de residuos sólidos ubicado en La Carpio, que recibe la gran mayoría de los desechos generados en esta región, ha alcanzado niveles críticos de acumulación que hacen prever su saturación total en un plazo máximo de 5 a 7 meses. Mientras que el relleno de Los Pinos ya ha quedado fuera de operación. Lo anterior conlleva una alta presión para el relleno sanitario de El Huazo-Aczerrí (actualmente recibe los desechos del relleno sanitario de Los Pinos), pues absorbería la totalidad de residuos que anteriormente se distribuían entre 3 rellenos sanitarios (La Carpio, Los Pinos, Los mangos), reduciendo considerablemente su vida útil restante y afectando particularmente a las comunidades aledañas a ese relleno, ubicadas a una calle de distancia. (Al efecto ver prueba documental 18). Adicionalmente, el otorgamiento de la presente medida cautelar permitiría mitigar la profundización de los daños y perjuicios que ha sufrido la accionante, pues ha realizado cuantiosas inversiones y esfuerzos para desarrollar un proyecto innovador que cumple a cabalidad con todos los requerimientos técnicos y legales exigidos por el ordenamiento jurídico.
PONDERACIÓN DE INTERESES: La medida cautelar solicitada no solo no lesiona el interés público, sino que más bien lo garantiza en su más alto grado al tutelar de forma preventiva la salud pública. Dada la audiencia de ley, la MUNICIPALIDAD DE MORA indicó sobre la competencia otorgada mediante la norma N° 8839, Ley Para la Gestión Integral de Residuos, la cual en su numeral 8, inciso B establece lo siguiente: “(…) ARTÍCULO 8.- Funciones de las municipalidades: Las municipalidades serán responsables de la gestión integral de los residuos generados en su cantón; para ello deberán: b) Dictar los reglamentos en el cantón para la clasificación, recolección selectiva y disposición final de residuos, los cuales deberán responder a los objetivos de esta Ley y su Reglamento. (…)” (El resaltado es propio). Continúa manifestando la Municipalidad que de esta manera, puede verse como la Municipalidad de Mora ha actuado en todo momento bajo el principio de legalidad y por ende, se encuentra ejerciendo las funciones que le han sido conferidas por medio de la norma supra indicada.
Aunado a lo anterior se tiene como la misma Procuraduría General de la República ha indicado como las municipalidades se encuentra legalmente facultadas para emitir normativa que regule el tema de residuos, esto mediante criterio N° C-066-2016 de fecha del 04 de abril de 2016, del cual se extrae lo siguiente: “(…) Consecuentemente, no es que las municipalidades se encuentren imposibilitadas para dictar reglamentos en esta materia, sino que su contenido debe quedar limitado a los temas que le han sido autorizados por ley. En lo que respecta a la gestión integral de residuos y el manejo de rellenos sanitarios o plantas industriales, las municipalidades deben someterse a la reglamentación nacional emitida por el Poder Ejecutivo como parte de la Política Nacional y el Plan Nacional de Gestión Integral de Residuos, por lo que si emiten normativa en esta materia deberá quedar sujeta a los lineamientos establecidos en tales disposiciones de carácter nacional.
(…)” Respecto del peligro en la demora: Es importante para esta administración recalcar el hecho de que el proyecto que pretende generar la parte actora, el cual consiste en el establecimiento de un relleno sanitario, encierra una gran serie de variantes ambientales que deben ser analizados, pues es necesario realizar o actualizar un análisis técnico y detallado que tenga como fin último y prioritario el resguardo del medio ambiente y la salud pública, evitando de esta manera, que llegue a generarse un posible daño ambiental que, por su propia génesis, no pueda ser retrotraído. Respecto de la ponderación de intereses: Es necesario tomar en cuenta que el Reglamento del servicio público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos del Cantón de Mora, regula toda una serie de temas tales como proyectos educativos, políticas sobre el almacenamiento, clasificación, separación de residuos, sobre la recuperación de residuos, el transporte de estos, centros de acopio, temas varios sobre reciclaje, registro estadísticos, sobre el servicio de recolección, limpieza de vías y sitios públicos, prohibiciones, multas y sanciones, siendo todos estos temas para los cuales la Municipalidad se encuentra facultada de conformidad con el bloque de legalidad aquí expuesto, sin que tales funciones ni dicho cuerpo normativo municipal como tal realice una invasión de las competencias que ostenta por ley el Ministerio de Salud.
Finalmente indica la municipalidad,de todas las pretensiones pretendidas por la parte actora, es importante señalar que el caso de la pretensión segunda, sobre la rendición de una garantía por parte de este Municipio, es completamente desproporcional, pues la misma podría generar una gravísima afectación a las finanzas de la Municipalidad de Mora, conllevando a una afectación de diversos programas y servicios que son ofrecidos por dicha institución a favor de todas las personas que tienen algún tipo de vinculación con el cantón de Mora, razón por la cual es necesario ponderar tal medida en el tanto que la misma acarrearía una fuerte afectación al bien común que persigue este Gobierno Local en favor de toda la población, así como el incumplimiento del numeral 170 de la Constitución Política con respecto a las funciones que debe ser desarrolladas y atendida por las Municipalidades. Así también, tome en cuenta este Tribunal que como ya ha sido indicado en la presente el Reglamento del servicio público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos del Cantón de Mora, regula una gran cantidad de temas y aspectos medulares que son necesarios para el debido funcionamiento de esta corporación, así como de los servicios ofrecidos a la comunidad, por lo que en caso de que se estime pertinente proceder con la medida cautelar solicita por la aquí actora, estímese conveniente no suspender la totalidad de dicha norma municipal, por lo que si ha bien lo tiene este tribunal procédase únicamente con la suspensión del transitorio II de dicho cuerpo normativo, el cual ha fungido como fundamento legal para la atención de las gestiones solicitadas a este Gobierno Local en relación con el proyecto del relleno sanitario.
Por su parte, la codemandada GRETEL AGUERO ALFARO, ante la audiencia concedida manifestó que la medida cautelar solicitada consiste en obligar a la Municipalidad de Mora a suspender los efectos del Reglamento del Servicio Público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos y a otorgar la autorización del desfogue pluvial solicitado por la empresa actora, entre otras pretensiones cautelares accesorias. Tales pretensiones cautelares son coincidentes, en contenido y extensión, con las pretensiones de fondo número uno y número 4, solicitadas en la demanda, con lo cual se está desnaturalizando el carácter de instrumentalidad de las medidas cautelares, pues su otorgamiento en este estado procesal equivaldría a estar concediendo parte de lo pedido por el fondo. En relación con la necesaria instrumentalidad de las medidas cautelares, la jurisprudencia del Tribunal Contencioso Administrativo se ha decantado por denegar aquellas solicitudes que implican el otorgamiento de la pretensión de fondo desde la medida cautelar.
Finalmente, al efectuar el análisis del peligro en la demora, no debe perderse de vista que estamos frente a un tema que roza aspectos de Salubridad Pública y Protección del Medio Ambiente, temas del más alto raigambre constitucional, ya que el derecho a la salud y a un ambiente sano y ecológicamente equilibrado son dos derechos humanos y fundamentales reconocidos, no solo por la propia Carta Magna costarricense, sino por los Convenios Internacionales suscritos por el país y frente a dicha realidad se requieren acciones concretas y efectivas que busquen de algún modo, paliar los efectos de actividades privadas que puedan significar un riesgo para esos bienes protegidos. En particular, el principio precautorio aconseja, tal como lo ha señalado reiteradamente la Sala Constitucional, que en caso de que exista un riesgo de daño grave o irreversible -o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate.
Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas y socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados al ambiente. De la misma prueba aportada por la parte actora se desprende que el proyecto de relleno sanitario que ha sido tramitado por la parte demandante ha sido acreditada como relleno sanitario en diferentes tramites, sin recuperación del valor de los residuos, véase la prueba 12 en donde se describe la actividad como Relleno Sanitario, y no como se ha afirmado por la parte demandante sin contemplar la revalorización de residuos, por lo que prolongaría la práctica bastante más rentable económicamente, de simplemente enterrar residuos de todo tipo, a pesar del desarrollo de tecnologías que podrían minimizar los impactos ambientales negativos, e incorporar las externalidades ambientales.

Según los estudios realizados por la municipalidad sería incluso más gravoso la instalación de un relleno sanitario en la finca propuesta por el proyecto. Y solicita declarar sin lugar las medidas peticionadas. CRITERIO DEL TRIBUNAL: Corresponde previamente al análisis de los presupuestos, valorar la instrumentalidad y provisionalidad de la medida peticionada. Respecto de la INSTRUMENTALIDAD y PROVISIONALIDAD de una medida cautelar, la misma consiste en procurar la efectividad del fallo judicial del proceso de fondo, la medida cautelar no puede tener una finalidad en sí misma y debe estar vinculada al proceso de fondo. En el caso concreto, el proceso de fondo pretende declarar la nulidad de resoluciones dictadas por la Municipalidad de Mora que rechazaron el permiso de desfogue pluvial con base en un Reglamento de la Municipalidad al considerar la parte que se da "abierta contradicción con el bloque de legalidad, mediante la aplicación improcedente de un reglamento inválido e ineficaz, y contraviniendo las autorizaciones previas otorgadas por los órganos rectores en materia de salud, ambiente y urbanismo, haciendo nugatorias las competencias de estas instancias" (análisis que corresponde al proceso de conocimiento y no a esta vía sumaria).
De un análisis de las pretensiones del proceso de conocimiento así como de las pretendidas medidas cauteles, es criterio de este Tribunal que conceder la medida cautelar principal o accesoria que pretende la promovente es otorgar por vía sumaria la pretensión de fondo, sea: obtener un permiso de desfogue pluvial. La parte promovente ofrece un conjunto de agravios, tendentes a acreditar la ilegalidad de los razonamientos sustantivos en que se basó la Municipalidad para rechazar el permiso de desfogue pluvial; análisis de fondo del proceso de conocimiento. Véase que la teoría del caso de la actora para conceder el permiso de desfogue se circunscribe a la ilegalidad del Reglamento de la Municiplaidad de Mora, así conceder la pretensión principal o accesoria número 1 ( "Pretensión principal: Se suspendan, de manera inmediata, los efectos del Reglamento del Servicio Público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos dictado por la Municipalidad de Mora.
Y a su vez se ordene a dicha Municipalidad otorgar provisionalmente a la actora, la autorización para el desfogue de aguas pluviales requerido para el desarrollo del Parque Industrial Jateo. Pretensión accesoria 1: Se autorice la continuación de los trámites en las diferentes Administraciones Públicas con competencia en cualquier aspecto del proyecto, y así mismo, el inicio de las obras del Parque Industrial Jateo.), es conceder en vía sumaria, un permiso cuyo sustento está condicionado al analisis del Reglamento indicado. Por otra parte, las pretensiones accesorias 2 y 3 se consideran prematuras e impertinentes en esta vía, por su orden . Con base en lo expuesto supra, se considera que la pretensión cautelar NO posee instrumentalidad ni provisionalidad, toda vez que lo que se pretende es que se conmine a la Municipalidad a otorgar un permiso de desfogue pluvial. No obstante lo anterior, se ampliará en el análisis de los presupuestos en caso de que se considere procedente el análisis de lo peticionado.
Si bien es cierto, el justiciable tiene la posibilidad de acudir a la vía contenciosa a cuestionar la validez de una decisión de la administración o norma reglamentaria que considera lesiva a sus derechos, siendo que de conformidad con los artículos 49 constitucional y 36 y 42 del CPCA, es posible recurrir a esta jurisdicción para cuestionar actuaciones administrativas como la que aquí refiere, configurándose preliminarmente la apariencia de buen derecho, siempre y cuando se considere con criterio distinto al expuesto por esta juzgadora que la pretensión cuenta con instrumentalidad y provisionalidad. Sustenta la actora la apariencia de buen derecho en la siguiente argumentación: "Incluso, la Procuraduría General de la República, órgano superior consultivo técnico-jurídico de la Administración Pública, ha dictaminado en reiteradas ocasiones (C-066-2016 y otros) que las municipalidades carecen de competencia para regular vía reglamento aspectos sustantivos y técnicos de la operación de rellenos sanitarios.
Esa potestad está reservada al Ministerio de Salud como órgano rector. Los reglamentos locales solo pueden normar asuntos puntuales de la gestión de residuos a nivel cantonal, sin contravenir la normativa y directrices de alcance nacional o invadir campos competenciales de otros entes. Por lo anterior, el rechazo de la denegatoria de desfogue de aguas que la Municipalidad ha dictado padece de vicios de fondo y forma calificables de nulidad absoluta, esencialmente, por invocar el Reglamento de Reglamento del Servicio Público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos que invade competencias de la administración con rectoría nacional en materia sanitaria, ambiental y urbanística, al impedir el desarrollo de proyectos de tratamiento de residuos, o en su caso, rellenos sanitarios, en la totalidad del territorio del cantón de Mora. Norma que además, que no fue publicada en La Gaceta de manera definitiva." Por su parte manifiesta la Municipalidad demandada que el Reglamento del servicio público para la Gestión Integral y Aprovechamiento de los Residuos Sólidos del Cantón de Mora, regula toda una serie de temas tales como proyectos educativos, políticas sobre el almacenamiento, clasificación, separación de residuos, sobre la recuperación de residuos, el transporte de estos, centros de acopio, temas varios sobre reciclaje, registro estadísticos, sobre el servicio de recolección, limpieza de vías y sitios públicos, prohibiciones, multas y sanciones, siendo todos estos temas para los cuales la Municipalidad se encuentra facultada de conformidad con el bloque de legalidad aquí expuesto, sin que tales funciones ni dicho cuerpo normativo municipal como tal realice una invasión de las competencias que ostenta por ley el Ministerio de Salud.
Análisis competencial resorte del proceso de conocimiento, en criterio de esta juzgadora. Respecto del PERICUMLUM IN MORA, debe recordarse que la carga de la prueba para acreditar la existencia de daños o perjuicios graves en los términos del artículo 21 del CPCA, es de la parte. Así se requiere que, para la procedencia de la tutela cautelar, la ejecución o permanencia de la conducta administrativa sometida al proceso produzca daños o perjuicios graves, actuales o potenciales, en la situación jurídica del promovente. En ese sentido, debe recalcarse que no basta con alegar la existencia del daño (o perjuicio) grave (actual o potencial), sino que debe probarse. En el caso concreto la PETENTE aduce que el otorgamiento de la presente medida cautelar permitiría mitigar la profundización de los daños y perjuicios que ha sufrido la accionante, pues ha realizado cuantiosas inversiones y esfuerzos para desarrollar un proyecto innovador que cumple a cabalidad con todos los requerimientos técnicos y legales exigidos por el ordenamiento jurídico; no obstante, no individualiza los daños, no individualiza las inversiones (créditos, activos, etc) ni los estima, no siendo suficiente alegarlos sin identificarlos y estimarlos.
No cumpliendo con el presupuesto de peligro en la demora en los términos del artículo 21 del CPCA, conviene inclinar la balanza a la protección del interés público. No obstante lo anterior, resulta importante indicar que la parte sustenta la necesidad de acoger la pretensión cautelar para evitar daños a la salud pública y al ambiente (al estar los demás rellenos sanitarios existentes a su capacidad máxima); pero en criterio de esta juzgadora, debe considerarse que al estar frente a aspectos de Salud Pública y Protección del Medio Ambiente nos encontramos ante derechos fundamentales que deben ser protegidos de acciones que puedan constituir un daño irreversible, haciendo eco de lo resuelto por la Sala Constitucional en Voto número 2024003959. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciseis de febrero de dos mil veinticuatro que dispuso respecto del PRINCIPIO PRECAUTORIO: "Así, cuando se está ante una situación que exige la aplicación del principio precautorio, los entes y órganos públicos deben abstenerse de autorizar, aprobar o permitir toda solicitud nueva o de modificación que razonablemente conlleve un riesgo grave; incluso, se encuentran obligados a suspender las actividades que se estén desarrollando.
Paralelamente tienen que adoptar con eficiencia y efectividad todas las medidas requeridas para la preservación de un ambiente sano y ecológicamente equilibrado" Y respecto del PRINCIPIO IN DUBIO PRO NATURA: "Por su parte, el principio in dubio pro natura significa, según la ‘Declaración Mundial de la Unión Internacional para la Conservación de la Naturaleza (UICN) acerca del Estado de Derecho en materia ambiental’ que “en caso de duda, todos los procesos ante tribunales, órganos administrativos y otros tomadores de decisión deberán ser resueltos de manera tal que favorezcan la protección y conservación del medio ambiente, dando preferencia a las alternativas menos perjudiciales. No se emprenderán acciones cuando sus potenciales efectos adversos sean desproporcionados o excesivos en relación con los beneficios derivados de los mismos (ver principio V). En tal sentido, según el documento ‘95 Principios Jurídicos Medioambientales para un Desarrollo Ecológicamente Sustentable’ (aprobados en la XIX Edición de la Cumbre Judicial Iberoamericana-2018 y por la Corte Plena en el artículo XIX de la sesión nro. 28-2020 del 25 de mayo de 2020), “Todo operador de las normas ambientales deberá tener siempre presente el principio pro naturaleza, conforme al cual se evitarán los riesgos, se privilegiarán los intereses colectivos generales sobre los particulares, se favorecerá la preservación del medio ambiente y en caso de duda se preferirá la interpretación que en forma más amplia proteja el entorno”.
El principio in dubio pro natura, no depende de que haya peligro de daño grave o irreversible -como sucede con el principio precautorio-, sino que implica que cuando exista un riesgo de afectación al medio ambiente, nos obliga a evitar optar por aquellas conductas que puedan causar daño al medio ambiente. En virtud de lo expuesto supra, se debe inclinar la balanza a la prevalencia del interés público y denegar las medidas peticionadas, como en efecto se dispone.
De conformidad con lo establecido en el artículo 24 del Código Procesal Contencioso Administrativo, respecto de la prueba testimonial ofrecida, la misma no se considera necesaria por cuanto con la prueba documental en autos en suficiente para dictar la presente resolución.
POR TANTO
Se RECHAZA la presente solicitud de medida cautelar en su carácter principal y accesorio, interpuesta por PARQUE INDUSTRIAL JATEO S.A. CONTRA LA MUNICIPALIDAD DE MORA. Se falla sin especial condenatoria en costas. Notifíquese. ALEJANDRA SOTO FONSECA, JUEZA TRAMITADORA.- ????????????????
