CONSIDERING:
I.PROVEN FACTS.- The Court concurs with the statement of facts found proven at first instance, subject to the following corrections: FACT SEVEN: The property was possessed from at least the 1970s, for more than forty-five years, its possessors being Francisco Luis Picado Godínez, José Luis Araya Figueroa and Gerardo Araya Sánchez (see the witness testimony of Eliécer Fernández Delgado, Eliécer Calderón Chinchilla and Carlos Rivera García).
II.UNPROVEN FACTS.- The Court does not concur with the facts found unproven regarding the duration and type of possession (posesión) exercised over the property.- That finding contradicts the proven facts and some of the substantive reasoning stated by the court below, which, as will be seen, is itself contradictory.
Ernesto Jiménez Mora, counsel for the petitioner in these possessory information proceedings, appealed the judgment, arguing as follows: 1. The cornerstone of titling (titulación) is to ensure the conservation, protection and administration of natural forests, and their use, through the principle of appropriate and sustainable use of resources, improvement of the population’s standard of living, and its effective incorporation into forestry activities; Article 18 of the Ley forestal prohibits the cutting and harvesting of forests. In this case, he argues, his client demonstrated agrarian possession (posesión agraria) over land received in its current condition; it has not degraded the land but, instead, has made improvements to keep water buffalo on the property by means of paddocks (apartos). It has also maintained the paddocks in the best possible condition. Furthermore, he adds, the property’s wetlands have been preserved in the best possible condition, with efforts made to maintain them without dredging them or causing irreversible harm or harm that would be difficult to remedy.
This differs, he argues, from the actions of other persons who cut down the trees before 1985, as the court below found. He adds that the agronomic knowledge of his client’s president has made it possible to manage the property ecologically in the condition in which it was received by assignment, improving the soils under difficult reforestation conditions. 2) Regarding the witness testimony, he states that all the witnesses are older persons who have lived in the area and testified to possession lasting more than forty years, beginning before 1985 and therefore predating the creation of Refugio Nacional de Vida Silvestre Barra del Colorado. He adds that neighboring properties in the area have been titled under the same conditions. He further states that the survey plan bears MINAE approval, thereby enabling the property to be titled. He therefore argues that the requirements were met and that a new survey plan was prepared to identify the location of the wetlands (L-9375-2023), also demonstrating ecological possession (posesión ecológica), because the property was taken over in a deforested condition for which his client was not responsible; instead, it has made improvements and transitioned to sustainable activities.
No levees, drainage works or land-drying works have been constructed, nor have the ecosystems been altered, as established by the audio and video recordings of the judicial inspection (reconocimiento judicial), with respect to alterations that could interrupt the existing natural cycles.
IV.This Agrarian Court has evaluated the evidence in accordance with the principles of free evaluation of evidence (libre valoración probatoria) (Article 54 of the Ley de Jurisdicción Agraria), criteria of law and equity, and the principle against retroactive application of laws.
It may therefore be inferred beyond any doubt that agrarian possession was already being exercised over the property in the 1970s, consisting of the establishment of pastures (repastos). This is evidenced by the fact that, by the year in which the Refuge was created (1985), more than ten years of possession had already elapsed, as confirmed by the photointerpretation study (estudio fotointerpretativo) identifying the forest cover (cobertura forestal) shown on the first survey plan submitted (L-1941820-2016), which indicates that forest cover had been reduced by 56.22% in 1985, the very year in which the Refuge was created, by which date approximately 15 years of possession would already have accrued. This agrarian possession was exercised in accordance with the laws then in force, particularly the Ley de Tierras y Colonización, which permitted occupation of untitled national lands (terrenos baldíos nacionales) as State agricultural lands, and the Ley de Informaciones Posesorias of 1941 itself, which established agrarian possession—an economic and social function—as a condition for acquiring ownership.
Based on its review of the videos of the judicial inspection, this Court finds that the property to be titled does indeed reflect longstanding possession, as evidenced by the existence of old fences dating back many years, as well as a dwelling house, corral and existing storage building, which show signs of having existed for several decades, given the condition of the wood and the infrastructure generally. It can likewise be observed that an agro-silvo-pastoral activity (actividad agro-silvo-pastoril) is being conducted, in that living fences of poró and other species have been incorporated into the paddocks, and the protection zones (zonas de protección) of the existing stream have been demarcated with natural poró fences. The foregoing considerations are sufficient to reverse the judgment on appeal and approve these proceedings, but not without first addressing certain considerations regarding wetlands on privately owned land.- In a case similar to the one now before us, this Court ruled:
“It is important to mention that the law would not be applied retroactively either, as the appellant claims, because the ten-year period of possession required for acquisitive prescription (usucapión) is established in the Civil Code, and the challenged provision merely highlights certain elements inherent to acquisitive prescription that are also defined in the general legislation, namely: the object of possession and the conditions under which possession must be exercised to qualify for acquisitive prescription. In this regard, it is important to note what the Sala Constitucional stated on the matter in the cited decision: ‘…The first paragraph of Article 7 of the challenged Ley de Informaciones Posesorias, the text of which predates the most recent amendment by Ley Forestal No.7575 of 13 de febrero de 1996, governs the titling of real property located within an area declared to be a national park, biological reserve, forest reserve, or protected zone.
That article provides that the applicant for title must demonstrate ten-year possession commencing at least ten years before the effective date of the law or decree that created the protected natural area (área silvestre). The challenged provision governs the titling of real property that has been dedicated to the public domain (dominio público) through its designation as a protected natural area (área silvestre protegida), regardless of its specific classification. It must now be determined whether, under the scenario contemplated by the challenged provision and in light of the doctrinal and jurisprudential criteria governing the legal doctrines of acquisitive prescription and the possession necessary for acquisitive prescription, as discussed above, the challenged provision regulates a special type of possession required to acquire ownership of real property, imposing specific requirements that may infringe the right to property or the principle against retroactive application of the law to the detriment of vested rights (derechos adquiridos) or settled legal situations (situaciones jurídicas consolidadas) protected by the Constitution.
First, it should be noted that the challenged article does not modify—increase or decrease—the ten-year period of possession required for acquisitive prescription, established in Article 860 of the Civil Code for the generality of cases in which ownership of real property is sought through positive prescription (prescripción positiva). The extension of the period that the petitioner claims infringes the right to property does not occur because, given the nature of the property for which title is sought (public property), the period of possession qualifying for acquisitive prescription must elapse before the property is dedicated to the public domain. In other words, designation as a protected natural area prevents possession after the dedication from being counted and precludes fulfillment of the requirements for acquisitive prescription if the right has not been acquired by that time—that is, if the ten years of possession qualifying for acquisitive prescription have not elapsed under the conditions established by law.
The foregoing is merely the natural result of applying the concepts concerning the object of possession and the condition that it be exercised as titleholder, which are required for possession for purposes of acquisitive prescription (posesión ad usucapionem). It should be recalled that property dedicated to the public domain, regardless of its particular characteristics, cannot be acquired through acquisitive prescription unless the conditions necessary to acquire the right were satisfied before the dedication occurred. Accordingly, although the challenged provision appears to regulate a specific case of acquisitive prescription, it does not create a regime with requirements different from those established in the Civil Code for the generality of cases. Likewise, the alleged retroactive effect of the provision does not occur, because the ten-year period of possession required for acquisitive prescription is established in the Civil Code, and the challenged provision merely highlights certain elements inherent to acquisitive prescription that are also defined in the general legislation, namely: the object of possession and the conditions under which possession must be exercised to qualify for acquisitive prescription.
In other words, the provision does not establish any different principle—or more stringent requirement—with respect to the application of the general rules governing acquisitive prescription. It merely specifies how those rules must be applied, which is consistent with the logical result arising from the public-domain status (condición de bien demanial) of the property for which title is sought. Therefore, the amendment to Article 7 of the Ley de Informaciones Posesorias, whose text is challenged, is not considered to have introduced a different regime concerning the requirements for acquisitive prescription that could have worsened the position of persons exercising possession for purposes of acquisitive prescription on land that was declared to be of public interest. (Tribunal Agrario, No. 173 de las 16:29 horas del 31 de marzo del 2003).’”
V.Accordingly, a possessor seeking to acquire by adverse possession (usucapión) land covered by forest that formed part of the national reserves (reservas nacionales) must prove ten-year possession (posesión decenal), whether original or transferred, and must have conserved the forest resource. This criterion was recently affirmed by the Constitutional Chamber (Sala Constitucional) in Voto No. 2015-0098, at 9 hours on 7 de enero del 2015, in response to a judicial constitutional consultation concerning titling within the national reserves: “VI.- TITLING OF LAND WITHIN THE NATIONAL RESERVES, THE STATE NATURAL HERITAGE, THIRD PARTIES WITH SUPERIOR RIGHTS, AND PRIVATE PROPERTY. In connection with the consultation submitted for its consideration, this Constitutional Court deems it necessary to draw a clear distinction between the concept of National Reserves and that of the State Natural Heritage (Patrimonio Natural del Estado), formerly known as the State Agricultural Heritage (Patrimonio Agrícola del Estado).
The Ley de Tierras y Colonización, No. 2825 of 14 de octubre de 1961, established the so-called State Agricultural Heritage in Article 7, based on the conception that agricultural property originally belonged to the Nation. The State Agricultural Heritage comprised all lands that were inalienable and could not be acquired by claim or possession (denuncio o posesión), including, among others, the maritime-terrestrial zone (zona marítimo terrestre), islands, the border strip, the strips along navigable rivers, and the two-kilometer radius surrounding volcanoes and national parks (Articles 7 through 10). In other words, the Heritage comprises lands having the characteristic of inalienability (inalienabilidad), subject to the public domain (dominio público), and included within some management category (categoría de manejo), such as national parks. The Law subsequently introduced a broad concept of National Reserves in Article 11, stating: ‘Unless proven otherwise, the following belong to the State as national reserves: a) All lands within the boundaries of the Republic that are not registered as private property or as property of the Municipalities or Autonomous Institutions; b) Those not protected by ten-year possession; c) Those that have not been designated by special laws for the establishment of agricultural colonies; and d) In general, all those that, while not privately owned, are not occupied for public services.’ It follows from the foregoing that lands forming part of the national reserves, as lands suited for agricultural, livestock, or forestry use, which had been possessed by private individuals for more than ten years and did not form part of the State Agricultural Heritage, were eligible for legal recognition.
Private individuals obtained such recognition through possessory-information proceedings (procesos de Información Posesoria) or through the mechanism created by Multiple Land Titling (Titulación Múltiple de Tierras), subsequently called ‘Titulación de Tierras Ubicadas en las Reservas Nacionales.’ The Ley Forestal No. 4465 of 1969 then introduced the concept of the State Forest Heritage (Patrimonio Forestal del Estado), entrusting the Dirección General Forestal with the forestry administration of forest reserves, national parks, State forest nurseries, protected zones, and biological reserves. At that time, the Public Administration realized that the two legal regimes coexisted within the so-called ‘national reserves’; consequently, in 1972, representatives of the Ministerio de Agricultura y Ganadería, to which the Dirección General Forestal belonged, the Instituto de Tierras y Colonización, and the Instituto Costarricense de Turismo signed an agreement precisely defining the powers of the three agencies over the national reserves (Convenio MAG-ITCO-ICT), 7 marzo 1972, La Gaceta No. 89 of 10 de mayo de 1972).
This occurred because the still-effective Ley de Tierras y Colonización entrusted the administration of national reserves suited for agricultural and livestock use to the Instituto de Tierras y Colonización, the agency responsible for subdivision into parcels (parcelación) and colonization. For its part, the Ley Orgánica del Ambiente No. 7554 of 1995 incorporated the concept of protected wildland areas (áreas silvestres protegidas), stating that they form part of the State Natural Heritage and establishing their irreducible status (carácter irreductible) (Articles 32 through 38). Subsequently, the currently effective Ley Forestal No. 7575 of 1996 incorporated, in Title Two, Sole Chapter, the concept of the State Natural Heritage, even clarifying which portions of the national reserves it encompasses: ‘The State Natural Heritage shall consist of the forests and forestlands (terrenos forestales) of the national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other Public Administration agencies, except for real properties securing credit transactions with the National Banking System that become part of its assets.
The Ministerio del Ambiente y Energía shall administer the Heritage.’ Because they are not forestlands, the foregoing excludes from the State Natural Heritage lands suited for agricultural and livestock use, which continue to form part of the national reserves and may be acquired by private individuals through adverse possession. Finally, the same Ley Forestal of 1996 amended Article 37 of the Ley Orgánica del Ambiente and Article 7 of the Ley de Informaciones Posesorias to authorize adverse possession—and therefore registration through possessory information (información posesoria), as well as through the now-repealed procedure for titling within national reserves—of lands belonging to national reserves and suited for forestry use, and even lands in private possession that were included within a category of protected wildland area (State Natural Heritage), provided that ten-year possession predating the creation of the respective area was proven and that the acts of agricultural possession (actos posesorios agrarios) consisted of activities directed toward forest or ecological protection.
In light of all the foregoing, it is therefore clear that the administrative procedure created by the Ley de Titulación Múltiple de tierras, subsequently the Ley de Titulación en las Reservas Nacionales, was intended to expedite titling procedures for agricultural possessors who had completed short-term adverse possession (usucapión corta)—initially three and later five years—so that they could obtain title to the property and gain access to land, agricultural credit, and adequate housing. This was without prejudice to third parties with superior rights (terceros de mejor derecho), understood as those private individuals who could have brought an action asserting a superior right of possession (acción de mejor derecho de posesión) within areas deemed national reserves. They had only three years in which to assert that right; otherwise, the title would become fully vested, because the legislature had shortened the limitation period for extinguishment of claims (prescripción negativa).
A different situation arises, however, with respect to private property affected by those multiple land-titling proceedings. It was logical that, upon the creation of a Multiple Titling Program (Programa de Titulación Múltiple), property established and registered in the name of the Instituto de Tierras y Colonización, later the Instituto de Desarrollo Agrario, would overlap with properties registered in the names of private individuals, since the requirement was that at least 20% of the land within the delimited geographical area lack a title registered in the public registry. Consequently, this meant that the title granted by ITCO covered land within the national reserves, not land previously registered as the private property of individuals. The foregoing clarifies that if titling was authorized and the resulting title covered, in whole or in part, a privately owned property that had previously been registered, the registered owner (propietario registral) would have the right to recover the property (reivindicar), as the same provision establishes, but not within the three-year period applicable to third parties with superior rights; rather, within the ten-year period.” VI.- In this particular case, the requirement imposed by the Ley de Informaciones Posesorias in Articles 1, 6, and 7 is deemed proven.
Indeed, the applicant for title (titulante) submitted cadastral plans (planos catastrados) No. A-1587501-2012 and A-1587536-2012, which describe pastureland and forestland located in La Poma de San Rafael de Guatuso de la Provincia de Alajuela. The previous plans dated from 1973, which means not only that the property reflects a lengthy period of possession, but also that it has been devoted to agricultural, livestock, and forestry activities. Notwithstanding the foregoing, the INTA certifications 8certifications on pages 34 through 37 of the digitized case file) state that, pursuant to Article 58 of the Reglamento a la Ley de Uso, Manejo y Conservación de Suelos and based on the site visit, it was determined that the land had been used in accordance with the stated activity; that grazing pastures and forest cover (cobertura forestal) exist; and that, far from harming the resource, sustainable agricultural, livestock, and forestry activities had been conducted.
It was therefore concluded that sustainable possession (posesión sostenible) had been exercised, which may also be verified in the judicial inspection record (acta de reconocimiento judicial) and in the witness statements (declaraciones testimoniales) (pages 94 through 96 of the digitized case file), which indicate that livestock are raised on the land and that the forests are duly protected. (END OF QUOTATION). VI.- In this particular case, the requirement imposed by the Ley de Informaciones Posesorias in Articles 1, 6, and 7 is deemed proven. Indeed, the applicant for title submitted cadastral plans No. A-1587501-2012 and A-1587536-2012, which describe pastureland and forestland located in La Poma de San Rafael de Guatuso de la Provincia de Alajuela. The previous plans dated from 1973, which means not only that the property reflects a lengthy period of possession, but also that it has been devoted to agricultural, livestock, and forestry activities.

It was therefore concluded that sustainable possession had been exercised, which may also be verified in the judicial inspection record and in the witness statements (pages 94 through 96 of the digitized case file), which indicate that livestock are raised on the land and that the forests are duly protected. (Tribunal Agrario No.1011-F-15 of 02 de octubre de 2015)
VI.Regarding wetlands (humedales) on private land.- In Voto N° 734-F-14 of sixteen hours and fifty-one minutes on veintiocho de agosto de dos mil catorce, this Court held: “This Court has had the opportunity to rule on matters similar to the one before us, stating as follows: “VI.- Finally, with respect to the second ground of appeal, concerning the claim that wetlands are not subject to private ownership even when they have not been officially designated as such, the appellant is likewise incorrect. Recently, this Court stated: “IV.- The appellant’s grounds of appeal are without merit. Agro-environmental restrictions (limitaciones agroambientales) on property encompass numerous aspects of the conduct of productive activities and the conservation of natural resources, biodiversity, soil use and conservation, forest and ecosystem protection, the use and control of pesticides and chemically synthesized products, plant-health and animal- and plant-health controls, agricultural waste, water conservation, the use and management of wastewater in agriculture, and the restoration of soils and watersheds, among others.
In the following section, we shall refer only to some of these restrictions. Within the context of the constitutional principles and values described above, numerous agro-environmental laws began to be enacted. These laws not only marked the consolidation of a sustainable-development model, but also imposed a series of agro-environmental restrictions on property and freedom of enterprise, while seeking to consolidate a new agrarian and environmental or ecological culture. 1) The Ley Orgánica del Ambiente (No. 7554 del 4 de octubre de 1995) establishes the State’s obligation to foster sustainable economic and environmental development, which necessarily entails imposing environmental limits on the conduct of productive economic activities and the exercise of property rights. For those limits to be genuinely effective, however, a cultural shift is necessary. The traditional agrarian culture, in which only economic considerations mattered, must give way to an environmental or agro-environmental culture for sustainable development (Ley Orgánica del Ambiente, artículos 12, 13, 14, 15 y 16).
The most important restrictions imposed on property to ensure fulfillment of its economic, social, and environmental function include the following: A.- The conduct of any agro-environmental activity that may alter or destroy environmental components necessarily requires an environmental impact assessment (evaluación de impacto ambiental), which must be approved before the project begins. An assessment is also required when construction or infrastructure may affect marine and coastal resources or wetlands. B.- Land-use planning (ordenamiento territorial), intended to balance sustainable development, entails the territorial relocation of productive activities, which could significantly restrict property rights because consideration must be given, among other factors, to natural resources, predominant economic activities, land-use capability, and zoning by agricultural products and activities based on ecological and productive considerations.
C.- The Executive Branch is authorized to include privately owned properties necessary for fulfilling the environmental function within protected wilderness areas (áreas silvestres protegidas), or to create statutory easements (servidumbres legales) for ecological protection. In cases in which the law requires compensation, private parties may voluntarily submit to the forestry regime (régimen forestal), in which case an encumbrance on the property is recorded in the Public Registry (Ley Orgánica del Ambiente, artículo 37). D.- Activities intended to interrupt the natural cycles of wetland ecosystems and capable of causing their deterioration or elimination are prohibited (Ley orgánica del Ambiente, artículo 45). E.- Productive activities must prevent water pollution, treat wastewater, and prevent or minimize the deterioration or pollution of watersheds and soil. F.- Organic agriculture, as a means of conducting sustainable agrarian activities, constitutes a way of fulfilling the economic, social, and environmental function, because environmental certification is required for organic products obtained without the application of chemically synthesized inputs or products (artículos 73-75).
G.- Environmental credit (crédito ambiental) is intended to finance the costs of reducing pollution in production processes. When such processes involve land use, a land-management and land-use plan is required in accordance with land-use capability (Ley Orgánica del Ambiente, artículo 113). The structure and function of property are unquestionably conditioned in this instance by the environmental component required in the conduct of business activities. 2) The Ley Forestal (No. 7575 de 5 de febrero de 1996, reformada por leyes No. 7609 de 11 de junio de 1996, 7761 de 2 de abril de 1998 y 7788 de 30 de abril de 1998), guided by the constitutional principles governing the appropriate and sustainable use of renewable natural resources, establishes regulations for the conservation, protection, and administration of natural forests and for the production, harvesting, processing, and promotion of forest resources, seeking to involve private parties in the sustained conduct of forestry activities.
Although MINAE is authorized to create protected wilderness areas on private land, doing so requires compensation unless the owner elects to submit voluntarily to the forestry regime or the land is already State-owned as part of its National Reserves. The law establishes two clear restrictions in the interest of protected areas: a: “In the case of forest reserves, protective zones, and wildlife refuges, when payment or expropriation has not yet occurred and until it occurs, the areas shall be subject to an environmental land-use plan that includes an environmental impact assessment and, subsequently, to a resource management, restoration, and replacement plan.” (Ley Orgánica del Ambiente, artículo 37, en relación con el artículo 2 de la Ley Forestal. Dicha reforma fue introducida por la Ley de Biodiversidad, en el artículo 14). This constitutes a clear restriction intended to ensure fulfillment of the environmental function of property.
B. “When, based on scientific and technical justification concerning the public interest, it is determined by law that the land is indispensable for conserving biological diversity or water resources, a restriction on the property shall be established that prohibits tree cutting and land-use change (cambio de uso del suelo). This restriction shall be recorded as an encumbrance in the Public Registry.” (Ley Forestal, artículo 2 párrafo segundo). As can be seen, this is not an unreasonable restriction. On the contrary, the owner may carry out an activity provided that it is compatible with the environmental function inherently assigned to the property for the conservation of water resources or biological diversity. Title III of the law, concerning private forest property as a special category of property, establishes a set of rights and obligations for forest owners that condition fulfillment of the environmental function according to the nature of the property: a) Owners may not change the land use or establish forest plantations.
The State Forestry Administration may, however, grant permission to perform works ancillary to agroforestry activities, provided that forest cutting is limited, proportionate, and reasonable (Ley Forestal, artículo 19. Cuando sea necesario, se exigiría evaluación de impacto ambiental); b) Forest harvesting (aprovechamiento del bosque) may be undertaken only if the owner has a management plan (plan de manejo) addressing the impact that may be caused to the environment, in accordance with scientific sustainability criteria; c) Payment for environmental services (pago por servicios ambientales) (the law defines environmental services as: “Those provided by forests and forest plantations that have a direct effect on environmental protection and improvement. They are the following: mitigation of greenhouse-gas emissions through fixation, reduction, sequestration, storage, and absorption; protection of water for urban, rural, or hydroelectric use; protection of biodiversity for its conservation and sustainable, scientific, and pharmaceutical use; research and genetic improvement; and protection of ecosystems, forms of life, and natural scenic beauty for tourism and scientific purposes.”) constitutes one of the most modern manifestations of the exercise of the environmental function, because the owner undertakes to conserve the forest for a period of no less than twenty years in order to receive the Forest Conservation Certificate.
Owners wishing to place their property under forest regeneration may also receive the certificate for areas that, because of their degraded condition and environmental needs, must be converted to forestry use. The encumbrances and restrictions, as well as the incentives, are recorded in the Public Registry as encumbrances on the property; d) Forest plantations, including agroforestry systems and individually planted trees, do not require permits for cutting, transportation, processing, or export, except where there is a management plan arising from a forestry contract with the State; e) Every owner is prohibited from cutting or removing trees within the protection areas established by law for permanent springs (nacientes permanentes), rivers, lakes, and water springs (manantiales) (Ley Forestal, artículo 33 y 34.). f) Burning on or adjacent to forest land is prohibited unless the corresponding permit has been obtained from the State Forestry Administration; g) As part of the environmental function, properties voluntarily placed under the forestry regime or devoted to that activity enjoy special protection against encroachments, and their owners may request immediate protection from the police authorities; h) Forestry credit (crédito forestal) is established as a mechanism for financing small and medium-sized producers through loans and other means of promoting forest management, reforestation processes, forest nurseries, agroforestry systems, and the restoration of denuded areas.
Financing also includes payment for the environmental services provided by forests and forest plantations. Forested land and standing trees shall serve as collateral for such loans and shall be recorded as encumbrances on the property (Ley Forestal, artículos 46, 48 y 49). 3).- The Ley de Uso, Manejo y Conservación de Suelos (No. 7779 de 30 de abril de 1998) is of fundamental importance to fulfilling the economic, social, and environmental function of property. Its purpose is to achieve the sustainable management, conservation, and restoration of soils in an integrated manner with other natural resources, secure more active participation by communities and producers, and promote the implementation and oversight of improved practices in land-use systems to prevent erosion and degradation of the resource. Agroecology is proposed as a means of bringing together the objectives of agricultural production and the conservation of soil and water resources.
The law establishes a set of agro-environmental restrictions to achieve the stated objectives: In critical areas of watersheds or sub-watersheds (where degradation of the soil and its surroundings is severe enough to limit any activity), whether publicly or privately owned, landowners must mandatorily implement all measures and practices necessary for soil restoration and preservation of the environment in general.
Every award of land made by the Instituto de Desarrollo Agrario shall be subject to the limitation that the land may not be used contrary to its land-use capability (capacidad de uso), noncompliance with which constitutes grounds for revocation. The obligations of private parties include, among others: Promoting, contributing to, and carrying out all practices and activities necessary for soil management, conservation, and restoration; monitoring and overseeing compliance with soil legislation is both a right and an obligation; preventing soil degradation that may be caused by water, for which purpose all practices that increase infiltration capacity on their land or channel excess water toward natural watercourses must be applied; preventing or stopping the contamination of aquifers and groundwater strata; and allowing authorized technical personnel to enter in order to verify the maintenance of soil-management, conservation, and restoration practices. 4) The foregoing are perhaps the most important limitations established by the Legislature to ensure fulfillment of the environmental function of property (función ambiental de la propiedad).
V.- The regulations implementing the Ley sobre Uso, Manejo y Conservación de Suelos (No 29375-, MAG-MINAE-S-HACIENDA-MOPT) contain, in Title IV, “Punishable Actions,” Chapter III, “Agrarian Jurisdiction,” under which the agrarian judge is granted sufficient authority to request, in any proceeding, a soil- and water-use and management study, providing that: “If noncompliance is demonstrated, regardless of the outcome of the proceeding, the noncompliant parties shall be ordered, within the period granted for that purpose, to bring their activities and practices into conformity with the soil-management plans...” (Article 159); moreover, “...the court may order the agricultural operator to adopt the measures established for that purpose by the National Plan, the Area Management Plan or, where applicable, the study on the use, management, and conservation of soils, water, and roads specifically applicable to the farm or micro-watershed concerned....” (Article 161).
If those orders are not complied with by implementing soil-management practices in accordance with the technology approved for that purpose, the processing of the possessory title proceeding (información posesoria) must be denied.” (See, among others, voto N° 659-F-10 de las 11:00 hrs. del 9 de julio de 2010, voto N° 897-F-2013 de este Tribunal). In the present case, official letter Nº ACAHN-SCH-855-11, issued by the Sistema Nacional de Areas de Conservación, states that there is a swamp with the characteristics of a wetland (humedal), measuring approximately 36 hectares. It states that it has not been officially designated as such. In any event, this is a wetland on privately owned land that is not part of the Patrimonio Natural del Estado and is not administered by MINAET, as interpreted by the Procuraduría. This is because the constitutional challenge (acción de inconstitucionalidad) was aimed solely at determining the administration of property belonging to the Patrimonio Natural del Estado, whether or not it had been designated as a protected zone or area.
In the present case, by contrast, the property before us has been subject to private ownership for more than ten years. It is also evident in the present case that the property for which title is sought fulfills the economic, social, and environmental function of property. According to the INTA report, its use conforms to the permitted land use (uso conforme del suelo). These are clearly statutory protection zones (zonas de protección legal) provided for in the Ley Forestal as limitations on the right of ownership; however, the protected area (área de protección) remains part of the property under Articles 33 and 34 of the Law, as the trial judge noted in the judgment. The requirements for safeguarding the public interest are therefore met (See, to similar effect, voto de este Tribunal No. 636-F-13 y el 515-F-2012 ). It is important to bear in mind that, although a wetland exists, the significance of the foregoing lies in the fact that it is an area that must be protected because wetlands are highly vulnerable and fragile ecosystems that provide a series of environmental services (servicios ambientales); their protection and conservation are therefore important regardless of whether they have been officially designated as such, and that is precisely what the Sala Constitucional held in Voto 16938-11, cited above.
Furthermore, the judgment establishes those limitations aimed at its conservation and protection.” Thus, there can be no doubt that wetlands are of public interest (interés público), which is not equivalent to the public domain (dominio público), and therefore the exclusion of that area from the survey plan should not be required. The situation is different for wetlands that form part of Áreas Silvestres Protegidas, in which case they would be part of the public domain, which is not the situation here...” The Sala Constitucional has likewise interpreted it this way when analyzing the public-domain regime and the Patrimonio Natural del Estado (sentencia No. 2012-16629 del 18 de noviembre del 2012). To the same effect, sentencias de este Tribunal No. 693-2016. In this particular case, it is evident that slightly more than 17 hectares were excluded from the original survey plan, which encompassed more than 47 hectares, and that the Juzgado, in its ruling issued at 7:35 on 27 de setiembre del 2022, ordered the submission of a new survey plan excluding the areas: “...Accordingly, when the current survey plan in these proceedings was submitted, the exclusion of those areas evidently resulted in a reduction in the area of the property....” (see the reasoning of the court a quo at the end of Considerando VI). This represents more than 30% of the total land for which title was originally sought.
VII.In view of the foregoing, the judgment on appeal is reversed. In its place, it is ordered as follows: The Registro Público Inmobiliario is ordered to register, in the name of ARAYA Y JIMÉNEZ SOCIEDAD ANÓNIMA, corporate identification number 3-101-100019, represented by Efraín Araya Sánchez, identity card number 1-0457-0096, the property described as follows: nature: pastureland, wetland, with a house. Located in La Pajarera, in DISTRICT three, La Rita, CANTON two, POCOCÍ, province of LIMÓN. BOUNDARIES: to the NORTH: Efraín Araya Sánchez; to the SOUTH: Consorcio Agrícola Marechachi Sociedad Anónima, Luis Eliecer, Luis Ángel, Lilliam, Nain, Seidy, Roiner Alex, Marvin, and Norman, all surnamed Calderón Padilla; to the EAST: Brazo del Río Chirripo; and to the WEST: a public road, with six hundred twenty-four meters and one linear centimeter of frontage thereon. AREA: thirty hectares and nine thousand four hundred five square meters, as shown on cadastral plan (plano catastrado) number 7-9375-2023.
These proceedings were valued at four million colones. The petitioner has exercised possession (posesión) for more than fifty years, including that of her prior transferor (anterior trasmitente). The property is located within Refugio Nacional de Vida Silvestre Barra del Colorado, created pursuant to Decreto Ejecutivo Nº 16358-MAG, del 26 de julio de 1985, and Reforma a la Declaración del Refugio N° 31804-MINAE, and remains subject to the reservations and restrictions (reservas y limitaciones) contained in Ley General de Caminos Públicos, Ley de Aguas, Articles 72 and 73 thereof, and Ley Forestal, Articles 13, 14, and 33. The property was valued at fifty million colones for tax purposes.- The trial judge shall issue the corresponding registration writ (mandamiento).
POR TANTO:
The judgment on appeal is reversed. In its place, these possessory information proceedings (diligencias de información posesoria) are granted, and it is ordered as follows: The Registro Público Inmobiliario is ordered to register, in the name of ARAYA Y JIMÉNEZ SOCIEDAD ANÓNIMA, corporate identification number 3-101-100019, represented by Efraín Araya Sánchez, identity card number 1-0457-0096, the property described as follows: nature: pastureland, wetland, with a house. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las trece horas cuarenta y seis minutos del dieciocho de noviembre de dos mil veinticuatro.- PROCESO DE INFORMACIÓN POSESORIA promovida por ARAYA Y JIMÉNEZ SOCIEDAD ANÓNIMA, cédula jurídica tres - ciento uno - cien mil diecinueve, representada por Efraín Araya Sánchez, cédula de identidad número uno - cuatrocientos cincuenta y siete - cero noventa y seis. Intervienen en el proceso la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Yamileth Monestel Vargas, mayor, soltera, vecina de San Ramón de Alajuela, cédula de identidad número dos - quinientos cuarenta y cinco - seiscientos uno, en su condición de procuradora; y el INSTITUTO DE DESARROLLO RURAL, cédula jurídica cuatro - cero cero cero - cero cuarenta y dos mil ciento cuarenta y tres - once, representado por su apoderada general judicial Marjorie Mayela Madrigal Muñoz, mayor, casada, abogada, vecina de San Ramón de Alajuela, cédula de identidad uno - quinientos noventa y ocho - ciento uno, colegiada veintiún mil trescientos cuarenta y dos. Actúa como apoderado especial judicial de la parte promovente, el licenciado Ernesto Jiménez Mora, colegiado dieciocho mil seiscientos sesenta. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles.-
RESULTANDO:
Redacta el juez ULATE CHACÓN, y,
CONSIDERANDO:
I.HECHOS PROBADOS.- El Tribunal comparte la relación de hechos tenidos por demostrados en primera instancia, con las siguientes correcciones: HECHO SIETE: El inmueble fue poseído desde, al menos los años 70, por más de cuarenta y cinco años, siendo sus poseedores por Francisco Luis Picado Godínez, José Luis Araya Figueroa y Gerardo Araya Sánchez (ver declaraciones testimoniales de Eliécer Fernández Delgado, Eliécer Calderón Chinchilla y Carlos Rivera García).
II.HECHOS NO PROBADOS.- No se comparten los hechos tenidos por indemostrados, en cuanto al tiempo de la posesión y el tipo de posesión ejercida en el inmueble.- Ello es contradictorio con los hechos probados y algunos de los razonamientos de fondo vertidos por el a-quo, los cuales, como se verá, son contradictorios.
El abogado de la gestionante de las presentes diligencias de información posesoria, Ernesto Jiménez Mora, apeló el fallo aduciendo lo siguiente: 1. El pilar de la titulación es velar por la conservación, protección y administración de los bosques naturales, y su aprovechamiento, a través del princpio de uso adecuado y sostenible de los recursos, el incremento del nivel de vida de la población y su efectiva incorporación a las actividades silviculturales, siendo que la Ley forestal, en su artículo 18 prohíbe la corta y aprovechamiento de bosques. En este caso, aduce, su representada demostró una posesión agraria sobre un terreno que se recibió como se encuentra actualmente, no lo ha desmejorado, sino más bien ha realizado mejoras para mantener búfalos de agua en la finca, a través de apartos. Además ha conservado en mejores condiciones posibles los apartos. Además, agrega, se han conservado en las mejores condiciones posibles los humedales de la finca, buscando mantenerlos sin dragarlos o causarles un daño irreversible o de difícil reparación.
A diferencia de otras personas, aduce, que antes de 1985 talaron los árboles, como lo analizó el a-quo. Los conocimientos en agronomía del presidente de su representada, agrega, han permido dar un tratamiento ecológico a la finca, en las condiciones que la recibieron por cesión, mejorando los suelos bajo una difícil reforestación. 2) Con respecto a la prueba testimonial, señala, todas son personas mayores que han vivido en la zona, hablaron de posesión de más de cuarenta años, desde antes de 1985, por lo que se da antes de la creación del Refugio Nacional de Vida Silvestre Barra del Colorado. En la zona, agrega, se han realizado titulaciones en fincas aledañas, en las mismas condiciones. Agrega, cuenta con el visado del plano por parte del MINAE, lo que le permite la posibilidad de titular. Por ello, aduce haber cumplido os requisitos, hizo un nuevo plano para determinar dónde están los humendales (L-9375-2023), demostrando además una posesión ecológica, pues el inmueble se tomó en un estado de deforestación no imputable a su representada, que más bien ha realizado mejoras, cambiando a actividades sostenibles.
No se han construido diques, drenajes o desecamientos, ni se han alterado los ecosistemas, tal y como queda determinado en el audio y video del reconocimiento judicial, con respecto a alteraciones que pueda interrumpir los ciclos naturales existentes.
IV.Este Tribunal Agrario ha procedido a valorar la prueba de conformidad con los principios de libre valoración probatoria (artículo 54 de la Ley de Jurisdicción Agraria), criterios de derecho y de equidad, así como el principio de irretroactividad en la aplicación de las normas en el tiempo.
De lo anterior se infiere, sin ninguna duda, que ya para los años 70 se ejerció posesión agraria sobre el inmueble, consistente en la realización de repastos, prueba de ello es que para el año en que se crea el Refugio (1985), ya habían pasado más de diez años de posesión, la cual se acredita con el estudio fotointerpretativo de la identificación de la cobertura forestal del primer plano aportado (L-1941820-2016), de donde se deriva que la cobertura forestal se redujo en un 56.22%, en el año 1985, justamente el año de la creación del Refugio, fecha para la cual ya se habría consolidado una posesión de aproximadamente 15 años. Posesión agraria ejercida de acuerdo a las normas vigentes en ese momento, en particular la Ley de Tierras y Colonización, que permitía la ocupación de los terrenos baldíos nacionales como terrenos agrícolas del Estado, y la misma Ley de Informaciones Posesorias de 1941, que establecía como condición para adquirir la propiedad la posesión agraria (función económica y social).
Este Tribunal considera que, de la observancia de los videos del reconocimiento judicial, el inmueble a titular, efectivamente acusa una larga posesión, lo cual se verifica en la existencia de cercas viejas de antigua data, así como de una casa de habitación, el corral y la bodega existente, que tienen vestigios de tener varias décadas de existencia, por el estado de la madera y la insfraestrucura en general. De igual manera se puede observar que hay una actividad agro-silvo-pastoril, en el sentido de que se han incorporado cercas vivas (de poró y otras especies) en los apartos, y se han delimitado las zonas de protección de la quebrada existente, con cercas naturales de poró. Las anteriores consideraciones son suficientes para revocar la sentencia recurrida y aprobar estas diligencias, no sin antes realizar algunas consideraciones sobre el tema de los humendales en terrenos privados.- En un caso similar al que ahora nos ocupa, este Tribunal dispuso:
"Es importante mencionar que tampoco se estaría aplicando retroactivamente la ley como lo indica el recurrente, porque el plazo de diez años de posesión para usucapir se encuentra establecido en el Código Civil y la disposición cuestionada simplemente destaca ciertos elementos propios de la usucapión que también están definidos en la normativa general, como son: el objeto de la posesión y las condiciones en que ésta se debe ejercer para ser apta para la usucapión. En ese sentido es importante señalar lo dicho por la Sala Constitucional al respecto en el voto citado “…El artículo 7 párrafo primero de la Ley de Informaciones Posesorias impugnado, cuyo texto es anterior a la última reforma por Ley Forestal No.7575 de 13 de febrero de 1996, regula el caso de la titulación de bienes inmuebles comprendidos dentro de un área declarada parque nacional, reserva biológica, reserva forestal o zona protectora.
Señala ese artículo que el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la ley o el decreto que creó el área silvestre. La disposición cuestionada regula el caso de titulación de un bien inmueble que ha sido afectado al dominio público con la declaratoria de área silvestre protegida, cualquiera que sea su especificidad. Corresponde ahora determinar si de acuerdo con la hipótesis que contempla la norma impugnada, a la luz de los criterios doctrinarios y jurisprudenciales que informan los institutos de la usucapión y de la posesión necesaria para usucapir, expuestos anteriormente, la norma cuestionada regula un tipo especial de posesión necesaria para adquirir la propiedad sobre los bienes inmuebles, que impone requisitos específicos que pueden infringir el derecho de propiedad o el principio de irretroactividad de la ley en perjuicio de derechos adquiridos o situaciones jurídicas consolidadas, regulados en la Constitución.
En primer término, debe señalarse que el artículo cuestionado no modifica -aumenta o disminuye- el plazo de diez años de posesión necesario para usucapir, fijado en el artículo 860 del Código Civil para la generalidad de los casos en que se pretende adquirir la propiedad de los bienes inmuebles por prescripción positiva. La ampliación del plazo que alega el accionante como infractor del derecho a la propiedad no se produce, porque dada la naturaleza del bien que se pretende titular (cosa pública), el plazo de posesión apta para la usucapión debe transcurrir antes de que se produzca la afectación del bien al dominio público. Es decir, la declaratoria de área silvestre protegida evita que cuente la posesión posterior a la afectación, e impide concretar los requisitos de la usucapión si a ese momento no se ha adquirido el derecho, o sea, no han transcurrido los diez años de posesión apta para usucapir con las condiciones que establece la ley.
Lo anterior es únicamente el resultado natural de aplicar los conceptos sobre el objeto de la posesión y su condición de ejercicio en calidad de titular, necesarios para la posesión ad usucapionem. Recuérdese que los bienes afectados al dominio público, tengan las especificaciones que tengan, no son susceptibles de adquisición por usucapión, si antes de producirse la afectación no se dieron las condiciones necesarias para la adquisición del derecho. En ese sentido, la disposición cuestionada, a pesar de que en apariencia regula un caso específico de usucapión, no crea un régimen con requisitos diferentes a los establecidos en el Código Civil para la generalidad de los casos. En ese sentido, tampoco se produce el alegado efecto retroactivo de la norma, porque el plazo de diez años de posesión para usucapir se encuentra establecido en el Código Civil y la disposición cuestionada simplemente destaca ciertos elementos propios de la usucapión que también están definidos en la normativa general, como son: el objeto de la posesión y las condiciones en que ésta se debe ejercer para ser apta para la usucapión.
Es decir, la norma no viene a establecer ningún principio diferente -o requisito más riguroso- en relación con la aplicación de las reglas generales de la usucapión. Simplemente especifica la forma en que deben aplicarse esas reglas, lo que coincide con un resultado lógico dada la condición de bien demanial del objeto a titular. De ahí que no se considere que la reforma al artículo 7 de la Ley de Informaciones Posesorias, cuyo texto se impugna, haya introducido un régimen diferente en relación con los requisitos de la usucapión, que haya podido agravar la situación de personas que se encontraban ejerciendo posesión ad usucapionem en terrenos que fueron declarados de interés público. (Tribunal Agrario, No. 173 de las 16:29 horas del 31 de marzo del 2003).
V.De manera que el poseedor que pretenda adquirir por usucapión un terreno cubierto de bosque, que formaba parte de las reservas nacionales, deberá demostrar la posesión decenal (originaria o trasmitida), y haber conservado el recurso forestal. Dicho criterio, fue ratificado, recientemente por la Sala Constitucional, en el Voto No. 2015-0098, de las 9 horas del 7 de enero del 2015, al responder una consulta judicial de constitucionalidad, relacionada con la titulación en las reservas nacionales: "VI.- LA TITULACIÓN DE TIERRAS EN LAS RESERVAS NACIONALES, EL PATRIMONIO NATURAL DEL ESTADO, LOS TERCEROS CON MEJOR DERECHO Y LA PROPIEDAD PRIVADA. Este Tribunal Constitucional, a propósito de la consulta sometida a conocimiento, considera necesario hacer la distinción clara entre el concepto de Reservas Nacionales, y aquél de Patrimonio Natural del Estado, antes denominado Patrimonio Agrícola del Estado.
La Ley de Tierras y Colonización, No. 2825 del 14 de octubre de 1961, en su artículo 7, estableció el llamado Patrimonio Agrícola del Estado, partiendo de una concepción de la propiedad agraria como originaria de la Nación. El Patrimonio agrícola del Estado comprendía todas las tierras inalienables y no susceptibles de adquirirse por denuncio o posesión, entre otras, la zona marítimo terrestre, las Islas, la franja fronteriza, las franjas de los ríos navegables, los dos kilómetros de radio en Volcanes y Parques Nacionales (artículos 7 al 10). Es decir, el Patrimonio comprende aquellos terrenos con características de inalienabilidad, sometidos al dominio público, y contenidos en alguna categoría de manejo, como los Parques Nacionales. Posteriormente la Ley introduce un concepto amplio de Reservas Nacionales, en el artículo 11, al indicar que “Mientras no se pruebe lo contrario, pertenecen al Estado en carácter de reservas nacionales: a) Todos los terrenos comprendidos dentro de los límites de la República que no estén inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autónomas; b) Los que no estén amparados por la posesión decenal; c) Los que, por leyes especiales, no hayan sido destinados a la formación de colonias agrícolas; y d) En general todos los que, no siendo de propiedad particular, no estén ocupados en servicios públicos.” De lo anterior se desprende que los terrenos que forman parte de las reservas nacionales, como terrenos de vocación agrícola, ganadera o forestal, poseídos por los particulares durante más de diez años y que no formen parte del Patrimonio agrícola del Estado, eran susceptibles de reconocimiento jurídico.
Tal reconocimiento lo alcanzan los particulares, a través de los procesos de Información Posesoria, o bien, mediante el instrumento que se creó a través de la Titulación Múltiple de Tierras, posteriormente denominada “Titulación de Tierras Ubicadas en las Reservas Nacionales”. Luego, la Ley Forestal No. 4465 de 1969, introduce el concepto de Patrimonio Forestal del Estado, confiriéndole la administración forestal, de las reservas forestales, los parques nacionales, los viveros forestales del Estado, las zonas protectoras y las reservas biológicas, a la Dirección General Forestal. En ese momento, la Administración Pública se percata de que dentro de las llamadas “reservas nacionales”, conviven los dos regímenes, por los que en 1972, suscriben un convenio representantes del Ministerio de Agricultura y Ganadería (de quien dependía la Dirección General Forestal), el Instituto de Tierras y Colonización y el Instituto Costarricense de Turismo, que definió con precisión las facultades de los tres organismos sobre las reservas nacionales (Convenio MAG-ITCO-ICT), 7 marzo 1972, La Gaceta No. 89 del 10 de mayo de 1972).
Lo anterior ocurre, porque la Ley de Tierras y Colonización, aún vigente, le confía la administración de las reservas nacionales, con vocación agropecuaria, al Instituto de Tierras y Colonización, órgano encargado de la parcelación y colonización. Por su parte, la Ley Orgánica del Ambiente No. 7554 de 1995, incorpora el concepto de áreas silvestre protegidas, indicando que forma parte del patrimonio natural del Estado y estableciendo su carácter irreductible (artículos 32 al 38). Posteriormente, la Ley Forestal vigente No. 7575 de 1996 incorpora, en el Titulo segundo, capítulo único el concepto de Patrimonio Natural del Estado, aclarando incluso, qué es lo que comprende de las reservas nacionales: “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.
El Ministerio del Ambiente y Energía administrará el patrimonio.” Lo anterior excluye como parte del patrimonio natural del Estado, por no ser forestal, los terrenos de aptitud agropecuaria, que siguen siendo parte de la reservas nacionales, y susceptibles de usucapión por parte de particulares. Finalmente, la misma Ley Forestal de 1996, modificó el artículo 37 de la Ley Orgánica del Ambiente, y el artículo 7 de la Ley de Informaciones Posesorias, para autorizar la usucapión, y por ende la inscripción mediante información posesoria (y el procedimiento derogado de la titulación en reservas nacionales), terrenos que pertenecen a las reservas nacionales, con vocación forestal e, incluso, terrenos en posesión privada, que quedaron comprendidos dentro de alguna categoría de área silvestre protegida (Patrimonio Natural del Estado), siempre y cuando se demostrara una posesión decenal anterior a la fecha de creación de la respectiva área, y los actos posesorios agrarios consistieran en actividades tendientes a la protección forestal o ecológica.
Con todo lo antes expuesto, resulta claro, entonces, que el procedimiento administrativo creado en la Ley de Titulación Múltiple de tierras (posteriormente, la Ley de Titulación en las Reservas Nacionales), vino a permitir agilizar los trámites de titulación de los poseedores agrarios, que habían cumplido una usucapión corta (primero de tres y luego de cinco años), para que pudieran obtener un título de propiedad, y tener posibilidades de acceso a la tierra, al crédito agrario y a la vivienda digna. Lo anterior, sin perjuicio de terceros de mejor derecho, entendiendo como tales, aquéllos particulares que pudieron haber ejercido una acción de mejor derecho de posesión, dentro de las zonas consideradas como reservas nacionales, para lo cual tenían solo tres años para reclamarlo, de lo contrario el título quedaría totalmente consolidado, pues el plazo de la prescripción negativa, fue reducido por el legislador.
Sin embargo, situación distinta ocurre con la propiedad privada afecta en esos procesos de titulación múltiple de tierras. Era lógico que al crear un Programa de Titulación Múltiple, la propiedad constituida e inscrita a nombre del Instituto de Tierras y Colonización, luego Instituto de Desarrollo Agrario, se sobreponía con propiedades inscritas a nombre de particulares (pues el requisito era que en la zona geográfica delimitada hubiera, al menos un 20% de terrenos sin título inscrito en el registro público). Ello suponía, en consecuencia, que el título que otorgaba el ITCO, lo era sobre terrenos de las reservas nacionales, no sobre terrenos inscritos anteriormente en propiedad privada de particulares. Lo anterior permite aclarar que si se autorizaba una titulación, y ese título recaía, total o parcialmente, sobre un inmueble particular anteriormente inscrito, el propietario registral tendría derecho a reivindicar, tal y como lo establece la misma norma, pero no dentro del plazo de tres años, aplicable a los terceros con mejor derecho, sino dentro del plazo de los diez años." VI.- En este caso particular, se tiene por demostrado el requisito exigido por la Ley de Informaciones Posesorias, en sus artículos 1, 6 y 7.
En efecto, el titulante, aportó los planos catastrado No. A-1587501-2012 y A-1587536-2012 que describen terrenos de potrero y bosque, situados en La Poma de San Rafael de Guatuso de la Provincia de Alajuela, siendo que los anteriores planos eran del año 1973 lo que significa que la finca no solamente acusa una larga posesión sino que también han sido dedicados a actividades agropecuarias y forestales. Pese a lo anterior, se nota en las certificaciones del INTA 8certificaciones de folios 34 a 37 del expediente digitalizado) indica que conforme al artículo 58 del Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, y con base en la visita de campo se determinó que se ha ejercido el uso conforme a la actividad, que existen repastos y cobertura forestal, lejos de afectar el recurso, se ha dado una actividad agropecuaria y forestal sostenible, por lo cual se concluye que se ha ejercido la posesión sostenible, lo cual también se puede verificar en el acta de reconocimiento judicial, y además en las declaraciones testimoniales (folios 94 a 96 del expediente digitalizado) en donde se indica que en los terrenos hay ganadería, y bosques debidamente protegidos.
(HASTA AQUÍ LA CITA). VI.- En este caso particular, se tiene por demostrado el requisito exigido por la Ley de Informaciones Posesorias, en sus artículos 1, 6 y 7. En efecto, el titulante, aportó los planos catastrado No. A-1587501-2012 y A-1587536-2012 que describen terrenos de potrero y bosque, situados en La Poma de San Rafael de Guatuso de la Provincia de Alajuela, siendo que los anteriores planos eran del año 1973 lo que significa que la finca no solamente acusa una larga posesión sino que también han sido dedicados a actividades agropecuarias y forestales. Pese a lo anterior, se nota en las certificaciones del INTA certificaciones de folios 34 a 37 del expediente digitalizado) indica que conforme al artículo 58 del Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, y con base en la visita de campo se determinó que se ha ejercido el uso conforme a la actividad, que existen repastos y cobertura forestal, lejos de afectar el recurso, se ha dado una actividad agropecuaria y forestal sostenible, por lo cual se concluye que se ha ejercido la posesión sostenible, lo cual también se puede verificar en el acta de reconocimiento judicial, y además en las declaraciones testimoniales (folios 94 a 96 del expediente digitalizado) en donde se indica que en los terrenos hay ganadería, y bosques debidamente protegidos.(Tribunal Agrario No.1011-F-15 del 02 de octubre de 2015)
VI.Sobre humedales en terrenos privados.- Este Tribunal en Voto N° 734-F-14 de las dieciséis horas y cincuenta y uno minutos del veintiocho de agosto de dos mil catorce: estableció: "Este Tribunal ha tenido la oportunidad de pronunciarse en asuntos similares al que nos ocupa, señalando lo siguiente: "VI.- Finalmente, tocante al segundo agravio, referente a que los humedales no son susceptibles de apropiación por los particulares, aún cuando aquellos no se encuentren decretados, tampoco lleva razón la recurrente. De reciente data, este Tribunal ha señalado: "IV.- No lleva razón la recurrente en sus agravios. Las limitaciones agroambientales de la propiedad, alcanzan gran cantidad de aspectos en el ejercicio de actividades productivas y en el ámbito de la conservación de los recursos naturales, la Biodiversidad, el uso y conservación de suelos, la protección del bosque y los ecosistemas, el uso y control de los plaguicidas y productos de síntesis química, el control fitosanitario y sanitario animal y vegetal, los desechos agrícolas, la conservación de las aguas, la utilización y manejo de aguas residuales en agricultura, la recuperación de suelos y cuencas hidrográficas, etcétera.
En el próximo apartado, haremos referencia solo a algunas de dichas limitaciones. Dentro del contexto de los principios y valores constitucionales descritos, comienza a dictarse gran cantidad de leyes agroambientales, que no solo marcan la consolidación de un modelo de desarrollo sostenible, sino que además, imponen una serie de limitaciones agroambientales a la propiedad y la libertad de empresa, buscando consolidar también una nueva cultura agraria y ambiental o ecológica. 1) La Ley Orgánica del Ambiente (No. 7554 del 4 de octubre de 1995) establece la obligación del Estado de propiciar un desarrollo económico y ambiental sostenible, lo que implica, necesariamente imponer límites ambientales al ejercicio de las actividades económicas productivas y al ejercicio del derecho de propiedad. Pero para que esos límites tengan una verdadera aplicación, es necesario un cambio cultural. De la cultura agraria tradicional, en donde solo importaba lo económico, debe pasarse a una cultura ambiental o agroambiental para el desarrollo sostenible (Ley Orgánica del Ambiente, artículos 12, 13, 14, 15 y 16).
Entre los límites más importantes impuestos a la propiedad, para garantizar la función económica, social y ambiental, pueden destacarse los siguientes: A.- El ejercicio de toda actividad agroambiental, que pueda alterar o destruir elementos del ambiente, requiere necesariamente de una evaluación de impacto ambiental, cuya aprobación debe ser previa al proyecto. También se exige la evaluación cuando por obras o infraestructura puedan afectarse recursos marinos, costeros y humedales. B.- El ordenamiento territorial, para equilibrar el desarrollo sostenible, implica la reubicación territorial de las actividades productivas, lo que podría significar límites importantes al derecho de propiedad, pues deben tomarse en consideración, entre otros aspectos, los recursos naturales, las actividades económicas predominantes, la capacidad de uso de los suelos y la zonificación por productos y actividades agropecuarias, en razón de consideraciones ecológicas y productivas.
C- El Poder Ejecutivo está facultado para incluir dentro de las áreas silvestres protegidas las fincas de particulares necesarias para el cumplimiento de la función ambiental, o crear las servidumbres legales para la protección ecológica. En los casos donde la Ley exija indemnización, los particulares pueden someterse voluntariamente al régimen forestal, caso en el cual la propiedad queda afectada en el Registro Público (Ley Orgánica del Ambiente, artículo 37). D.- Están prohibidas las actividades orientadas a interrumpir los ciclos naturales de los ecosistemas de humedales, que puedan provocar su deterioro y la eliminación (Ley orgánica del Ambiente, artículo 45). E.- Las actividades productivas deben evitar la contaminación del agua, dar tratamiento a las aguas residuales, impedir o minimizar el deterioro o contaminación de cuencas hidrográficas, así como del suelo. F.- La agricultura orgánica, como forma de ejercicio de actividades agrarias sostenibles, implica una forma de cumplimiento de la función económica, social y ambiental, pues se exige una certificación ambiental de los productos orgánicos que se hayan obtenido sin aplicar insumos o productos de síntesis química (artículos 73-75).
G.- El crédito ambiental: está destinado a financiar los costos de reducción de la contaminación en procesos productivos. Cuando implican el uso del suelo se requiere un plan de manejo y uso de tierras de conformidad con la capacidad de uso (Ley Orgánica del Ambiente, artículo 113). Indudablemente, la estructura de la propiedad y su función está condicionada, en este caso por el elemento ambiental, requerido en el ejercicio empresarial. 2) La Ley Forestal (No. 7575 de 5 de febrero de 1996, reformada por leyes No. 7609 de 11 de junio de 1996, 7761 de 2 de abril de 1998 y 7788 de 30 de abril de 1998), orientada por los principios constitucionales de uso adecuado y sostenible de los recursos naturales renovables, establece regulaciones en cuanto a la conservación, protección y administración de los bosques naturales, y por la producción, aprovechamiento, industrialización y fomento de los recursos forestales, buscando la incorporación de los particulares al ejercicio sostenido de actividades silviculturales.
Si bien es cierto, el MINAE está facultado para crear áreas silvestres protegidas en terrenos privados, ello requiere indemnización, salvo que el propietario decida someterse voluntariamente al régimen forestal, o sean ya propiedad del Estado, dentro de su patrimonio de Reservas Nacionales. La Ley prevé dos claros límites, en interés de las áreas protegidas: a: “Tratándose de reservas forestales, zonas protectoras y refugios de vida silvestre y en caso de que el pago o la expropiación no se haya efectuado y mientras se efectúa, las áreas quedarán sometidas a un plan de ordenamiento ambiental que incluye la evaluación de impacto ambiental y posteriormente, al plan de manejo, recuperación y reposición de recursos.” (Ley Orgánica del Ambiente, artículo 37, en relación con el artículo 2 de la Ley Forestal. Dicha reforma fue introducida por la Ley de Biodiversidad, en el artículo 14). Lo cual constituye un claro límite para el cumplimiento de la función ambiental de la propiedad.
B.“Cuando, previa justificación científica y técnica de interés público, se determine mediante ley que el terreno es imprescindible para conservar la diversidad biológica o los recursos hídricos, quedará constituida una limitación a la propiedad que impedirá cortar árboles y cambiar el uso del suelo. Esta restricción deberá inscribirse como afectación en el Registro Público.” (Ley Forestal, artículo 2 párrafo segundo). Como se observa, no se trata de un límite irrazonable. Por el contrario el propietario podría ejercer su actividad siempre y cuando sea compatible con la función ambiental que, por naturaleza, viene asignada al inmueble, para conservar recursos hídricos o diversidad biológica. El Título III de la Ley, referido a la propiedad forestal privada, como propiedad especial, establece un conjunto de derechos y obligaciones para los propietarios de bosques que condicionan el cumplimiento de la función ambiental, atendiendo a la naturaleza del bien: a) No es permitido a los titulares cambiar el uso del suelo, ni establecer plantaciones forestales.
Sin embargo, la Administración Forestal del Estado puede otorgar permiso para realizar obras complementarias a la actividad agroforestal, siempre y cuando la corta del bosque sea limitada, proporcional y razonable (Ley Forestal, artículo 19. Cuando sea necesario, se exigiría evaluación de impacto ambiental); b) El aprovechamiento del bosque solo se puede realizar si el propietario cuenta con un plan de manejo que contenga el impacto que pueda ocasionar al ambiente, según criterios de sostenibilidad científica; c) El pago por servicios ambientales (La Ley define los servicios ambientales como: “Los que brindan el bosque y las plantaciones forestales y que inciden directamente en la protección y el mejoramiento del medio ambiente. Son los siguientes: mitigación de emisiones de gases efecto invernadero (fijación, reducción, secuestro, almacenamiento y absorción), protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad para conservarla y uso sostenible, científico y farmacéutico, investigación y mejoramiento genético, protección de ecosistemas, formas de vida y belleza escénica natural para fines turísticos y científicos.), constituye una de las manifestaciones más modernas de ejercicio de la función ambiental, pues el propietario se compromete a conservar el bosque por un período no inferior a los veinte años, para recibir el Certificado de Conservación del Bosque.
También lo reciben los propietarios que deseen someter su inmueble a la regeneración del bosque, para áreas que por su estado deteriorado y necesidades ambientales, deben convertirse al uso forestal. Las afectaciones y limitaciones, así como los incentivos se inscribe en el Registro Público como afectación a la propiedad; d) Las plantaciones forestales, incluidos sistemas agroforestales y árboles plantados individualmente, no requieren permiso de corta, transporte, industrialización ni exportación, salvo cuanto exista plan de manejo derivado de un contrato forestal con el Estado; e) Todo propietario tiene prohibiciones de cortar o eliminar árboles en las áreas de protección establecidas por Ley para las nacientes permanentes, ríos, lagos y manantiales (Ley Forestal, artículo 33 y 34.). f) Está prohibido realizar quemas en terrenos forestales, ni aledaños, sin obtener el permiso respectivo de la Administración Forestal del Estado; g) Como parte de la función ambiental, los inmuebles sometidos voluntariamente al régimen forestal o dedicados a esa actividad, gozan de una protección especial respecto de invasiones, pudiendo solicitar la protección inmediata de las autoridades de policía; h) El crédito forestal, se consolida como instituto para financiar a pequeños y medianos productores, mediante créditos y otros mecanismos de fomento del manejo de bosques, procesos de reforestación, viveros forestales, sistemas agroforestales, recuperación de áreas denudadas.
El financiamiento comprende, además, el pago de los servicios ambientales que brindan los bosques y plantaciones forestales. La tierra con bosque y los árboles en pie servirán como garantía de dichos créditos, quedando anotadas como afectaciones a la propiedad (Ley Forestal, artículos 46, 48 y 49). 3).- La Ley de Uso, Manejo y Conservación de Suelos (No. 7779 de 30 de abril de 1998), es de fundamental importancia para el cumplimiento de la función económica, social y ambiental de la propiedad. Se pretende lograr el manejo, conservación y recuperación de suelos en forma sostenible, integrada con los demás recursos naturales, logrando una participación más activa de las comunidades y los productores, e impulsando la implementación y control de prácticas mejoradas en los sistemas de uso, para evitar la erosión y degradación del recurso. Se plantea la agroecología, como una forma de lograr la convergencia entre los objetivos de la producción agrícola y la conservación de los recursos suelo y agua.
La Ley plantea un conjunto de limitaciones agroambientales, para lograr cumplir con los objetivos señalados: En áreas críticas de cuencas o subcuencas (con gravedad en degradación del suelo y su entorno, como limitante a cualquier actividad), sean de dominio público o privado, los dueños de terrenos deben aplicar forzosamente todas las medidas y prácticas que conlleven la recuperación del suelo y preservación del ambiente en general. Toda adjudicación de terrenos que realice el Instituto de Desarrollo Agrario, tendrá como limitación que el uso del terreno no puede ir en contra de su capacidad de uso, cuyo incumplimiento se convierte en causal para revocarla. Como obligaciones de los particulares se establecen entre otras: Fomentar, contribuir y ejecutar todas las prácticas y actividades necesarias para el manejo, conservación y recuperación de suelos; es un derecho obligación vigilar y controlar el cumplimiento de la legislación en materia de suelos; prevenir la degradación de los suelos que pueda ser causada por las aguas, para lo cual deberán aplicarse todas las prácticas que aumenten la capacidad de infiltración en sus terrenos o la evacuación de aguas sobrantes hacia cauces naturales; prevenir o impedir la contaminación de acuíferos y capas de agua subterránea; permitir el ingreso de técnicos autorizados para verificar el mantenimiento de las prácticas de manejo, conservación y recuperación de suelos. 4) Quizás se han mencionado las limitaciones más importantes, establecidas por el Legislador, para el cumplimiento de la función ambiental de la propiedad.
V.- El reglamento a la Ley sobre Uso, Manejo y Conservación de Suelos (No 29375-, MAG-MINAE-S-HACIENDA-MOPT), contiene en el Título IV "De las acciones punibles", el capítulo III "De la Jurisdicción Agraria", en la cual se le otorgan suficientes poderes el juez agrario, para solicitar en cualquier proceso un estudio de uso y manejo de suelos y aguas, disponiéndose que "En caso de que se demostrare incumplimiento, indistintamente del resultado del proceso, deberá ordenar a las partes incumplientes que dentro del plazo que se otorgará al efecto, procedan a adecuar su actividad y prácticas a los planes de manejo del suelo..." (artículo 159) además, "...podrá ordenar que el empresario agrario adopte las medidas que a ese efecto establezca el Plan Nacional, el Plan de Manejo del Área o en su caso el estudio de uso manejo y conservación de suelos, aguas y caminos específico para la finca o la microcuenca que se trate...." (artículo 161), en el caso de que no se cumplan dichas prevenciones, cumpliendo con las prácticas de manejo de suelos de acuerdo con la tecnología aprobada al efecto, debe denegarse el trámite de la información posesoria." (véase entre otros voto N° 659-F-10 de las 11:00 hrs. del 9 de julio de 2010, voto N° 897-F-2013 de este Tribunal).
En el presente caso, el oficio Nº ACAHN-SCH-855-11, emitido por el Sistema Nacional de Areas de Conservación indica existe un suampo con características de humedal de aproximadamente 36 hectáreas. Dice no se encuentra declarado. En todo caso, véase se trata de un humedal en un terreno privado, que no es parte del Patrimonio Natural del Estado, ni está bajo la administración del MINAET, como lo interpreta la Procuraduría. Ello por cuanto la acción de inconstitucionalidad se dirigió a determinar la administración de los bienes que son Patrimonio Natural del Estado únicamente, sean declarados o no como zonas o áreas protegidas. Mientras que en el presente caso nos encontramos frente a un bien sometido a dominio privado desde hace más de diez años. En el presente caso, también se desprende que el inmueble a titular cumple con la función económica, social y ambiental de la propiedad. Según el informe del INTA, el mismo cumple el uso conforme del suelo.
Se trata, evidentemente, de zonas de protección legal, previstos en la Ley Forestal, como limitaciones del derecho de propiedad, pero el área de protección sigue formando parte del inmueble, artículos 33 y 34 de la Ley, como lo hizo ver el juez de instancia en su sentencia. Por ello se cumple con los requerimientos de tutela del interés público (Ver en sentido similar el voto de este Tribunal No. 636-F-13 y el 515-F-2012 ). Es importante tener presente si bien existe un humedal, la importante de lo anterior radica en que es un área que se debe proteger por cuanto los humedales son ecosistemas de gran vulnerabilidad, fragilidad y que prestan una serie de servicios ambientales por lo que es importante su protección y conservación, independientemente estén o no declarados como tales, y ello fue lo precisamente declarado por la Sala Constitucional en el Voto 16938-11, ya antes citado. Además la sentencia establece esas limitaciones tendientes a su conservación y protección".
De este modo no cabe duda que los humedales son de interés público lo que no equivale al dominio público, de manera que en el plano no debe de exigirse la exclusión de esa área del plano. Diferente es el caso de humedales que forman parte de Áreas Silvestres Protegidas en cuyo caso serían parte del dominio público, lo cual no sucede en la especie...". Así también lo ha interpretado la Sala Constitucional cuando ha analizado el régimen del dominio público y del Patrimonio Natural del Estado (sentencia No. 2012-16629 del 18 de noviembre del 2012). En igual sentido, sentencias de este Tribunal No. 693-2016. En este caso particular, es evidente que se excluyeron del plano original, que comprendía más de 47 hectáreas, un poco más de 17 hectáreas, siendo que el Juzgado, en resolución de las 7:35 horas del 27 de setiembre del 2022 previno aportar un nuevo plano exluyendo las zonas "...Siendo así, cuando se aporta el plano actual de estas diligencias evidentemente la exclusión de esas zonas incidieron en la disminución de la cabida del fundo....".(ver razonamiento del aq-uo, al final del Considerando VI). Lo que representa más del 30% del total del terreno que se pretendía titular originalmente.
VII.En virtud de lo expuesto, se revoca la sentencia apelada. En su lugar se resuelve: Se ordena al Registro Público Inmobiliario inscribir a nombre de la sociedad ARAYA Y JIMÉNEZ SOCIEDAD ANÓNIMA, cédula jurídica 3-101-100019, representada por Efraín Araya Sánchez, cédula de identidad número 1-0457-0096, la propiedad que se describe así: naturaleza de potrero, humedal, con una casa. Situada en La Pajarera, en el DISTRITO tres La Rita, CANTÓN segundo POCOCÍ, de la provincia de LIMÓN. COLINDA: al NORTE: Efraín Araya Sánchez, al SUR con el Consorcio Agrícola Marechachi Sociedad Anónima, Luis Eliecer, Luis Ángel, Lilliam, Nain, Seidy, Roiner Alex, Marvin y Norman, todos de apellidos Calderón Padilla, al ESTE con Brazo del Río Chirripo y al OESTE calle pública con un frente a ella de seiscientos veinticuatro metros con un centímetro lineal. MIDE: treinta hectáreas y nueve mil cuatrocientos cinco metros cuadrados, tal como lo indica el plano catastrado número 7-9375-2023.
Las presentes diligencias fue estimado en la suma de cuatro millones de colones. La promovente ha ejercido una posesión de más de cincuenta años, sumada a la de sus anterior trasmitente. El inmueble se ubica dentro del Refugio Nacional de Vida Silvestre Barra del Colorado creado según Decreto Ejecutivo Nº 16358-MAG, del 26 de julio de 1985 y la Reforma a la Declaración del Refugio N° 31804-MINAE, quedando sujeta a las reservas y limitaciones contenidas en la Ley General de Caminos Públicos, la Ley de Aguas, en sus artículos 72 y 73, y la Ley Forestal, artículos 13, 14 y 33. El inmueble fue estimado en la suma de cincuenta millones de colones para efectos fiscales.- Por parte del juzgador de primera instancia, expídase el mandamiento correspondiente.
POR TANTO:
Se revoca la sentencia apelada. En su lugar, se acogen las presentes diligencias de información posesoria y se resuelve: Se ordena al Registro Público Inmobiliario inscribir a nombre de la sociedad ARAYA Y JIMÉNEZ SOCIEDAD ANÓNIMA, cédula jurídica 3-101-100019, representada por Efraín Araya Sánchez, cédula de identidad número 1-0457-0096, la propiedad que se describe así: naturaleza de potrero, humedal, con una casa. Situada en La Pajarera, en el DISTRITO tres La Rita, CANTÓN segundo POCOCÍ, de la provincia de LIMÓN.
