As a result of the study, weaknesses were identified in the demarcation (delimitación) of the Park due to problems with the location of the boundary markers (mojones), since some areas are not properly defined geographically in its enabling law. Inconsistencies were also detected in the expropriation process (proceso de expropiación) for the properties, which could form part of the State Natural Heritage (Patrimonio Natural de Estado, PNE), since some of the parent properties (fincas madres) from which those properties were subdivided were titled administratively by the then ITCO, when the applicable regulations actually required possessory-information proceedings (proceso de información posesoria) before a court. Substantial weaknesses were identified, including the absence of internal procedures and of a specific strategy for carrying out the expropriations, deficiencies in the registered cadastral plans (planos catastrados), and problems with the identification, foliation, and contents of the respective case files (expedientes).
Technical weaknesses were also identified in the administrative appraisals (avalúos administrativos), with differences of up to 500% between the appraised prices for the same property or properties with similar conditions over two relatively short periods, as well as considerable differences between administrative and judicial appraisals. For example, a property with an administrative appraisal of 20,6 million was valued in judicial proceedings eleven months later at 1.264,2 million; in other words, the increase during that period was 6037%. Put differently, the price per square meter rose from approximately 7.200 colones to 442.000 colones. It was also confirmed that some properties within the PNMB belonged to the Municipalidad de Santa Cruz or remain under that municipality’s authority and have not yet been transferred to the Park Administration. It should be emphasized that the problems identified concerning the boundaries were unrelated to the term “aguas adentro,” since the Contraloría likewise concluded that it was the result of an unmistakable drafting error.
Its concern was the demarcation of the hill behind Playa Ventanas, the El Morro hill, and the area known as Isla Verde, which were not clearly defined, constituting an omission in Ley 7524. The other important matter analyzed was the titling of the properties located within the national park, since the Contraloría stated that all current lots originated from 6 parent properties titled in the early 70s, thereby registering the maritime-terrestrial zone (zona marítimo terrestre) pursuant to the transitional provision III (transitorio III) of Ley 4558. However, those proceedings were conducted administratively before the ITCO, and the titles could therefore be affected by defects rendering them absolutely null and void (vicios de nulidad absoluta). Those parent properties were located along the coastline of Parque Marino Las Baulas. In light of the foregoing, as already mentioned, the Contraloría ordered the Ministerio de Ambiente, among other things, to prepare an official map of Parque Nacional Marino Las Baulas accurately showing the National Park’s actual extent and boundaries.
It was also ordered to conduct the corresponding assessment of the cases involving parent properties titled by the ITCO in order to decide whether the appropriate legal actions should be filed for the possible recovery of State-owned properties. It was further ordered to consider suspending all expropriation proceedings and refrain from initiating new proceedings concerning properties derived from parent properties numbers 1, 2, 3 and 5; request new administrative appraisals; and prepare a strategy for expropriating the properties.” It states that the work required before carrying out the expropriations has encountered obstacles because of noncompliance by the contractor, Universidad Nacional, which has prevented the expropriations from resuming. It challenges the private land survey (estudio topográfico particular) submitted by the plaintiff in these proceedings to establish the location of the plaintiff’s 22 properties (inside or outside the PNMB perimeter): “The plaintiff submitted as evidence a private land survey concluding that 8 properties belonging to the plaintiff companies are located outside Parque Marino Las Baulas.
A review of that land survey shows that its authors are confused about the Park’s boundaries and appear to be unaware of the 125-meter strip measured from the ordinary high-tide line (pleamar ordinaria) that is included within this protected wildlife area (área silvestre protegida). They state that the lots are located within an area called zona protectora Las Baulas de Guanacaste, an area that does not exist, much less within the specified 125 meters. According to report ACT-OR-T-482-2022 by surveyor Fabián Bonilla of Área de Conservación Tempisque, the inconsistency between the boundaries in the SNIT layer for Áreas Silvestres Protegidas and resolution R-SINAC-CONAC-29-2019 alleged in the private land survey does not exist. He stated that the SNIT layer does not include the two portions of land belonging to Zona Protectora Ventanas that are located between the 125 m strip and the line marked by the boundary markers of Estero Ventanas.
Those two portions result from the demarcation of the mangrove (manglar), which has already been properly marked by boundary markers, and the 125-meter strip; in any event, those two small portions do not affect any of the lots involved in this case. The certificates (certificaciones) whose annulment the plaintiff seeks in these proceedings are administrative verification acts (actos administrativos de verificación). They merely establish the location of 22 properties in relation to the official boundaries of Parque Nacional Marino Las Baulas. They do not constitute unlawful conduct or acts contrary to the legal system. They are simple acts establishing whether these properties are inside or outside the established boundaries of the National Park. They do not even provide a legal assessment of the situation. At the request of this Procuraduría, the location of the 22 properties owned by the plaintiffs was reviewed again, and in report ACT-OR-432-2022, the surveyor from Área de Conservación Tempisque determined that all of them are located within the boundaries of Parque Nacional Marino Las Baulas, specifically within the 125 meters measured from the ordinary high-tide line.
Some properties are located entirely within the Park, while others overlap it only partially. The specified report states the percentage of overlap (traslape) for each one. In view of the foregoing, there is no legal basis for requesting the annulment of the certificates issued by Área de Conservación Tempisque, and I therefore request that the Court so declare.” Regarding the requested damages (daños y perjuicios), they ask that the claim be dismissed, arguing that the SINAC certificates “(...) likewise cause no harm to the plaintiff companies; they are merely administrative acts of verification. They indicate that the properties are located within the National Park according to its official boundaries and therefore contain no defect requiring their annulment and, consequently, do not cause the alleged damages. For State liability (responsabilidad del Estado) to arise, three requirements must be met: injurious or harmful conduct by the State (Article 190 of the General Public Administration Law (Ley General de la Administración Pública, LGAP)); actual, quantifiable, and individually ascertainable harm (Article 196 ibíd); and a causal relationship between the harm allegedly suffered and the conduct of the Public Administration (Article 190 ibíd).
None of these requirements is met in this case because, first, there has been no injurious action by the State, since all it has done is establish Parque Nacional Marino Las Baulas, which it is authorized to do. Second, the alleged harm claimed has not been established; and finally, there is no causal relationship between the alleged harm and the administrative acts whose annulment is sought. The claim for compensation (reclamo indemnizatorio) is therefore unfounded, and I request that the Court so declare.”- In its answer, SINAC rejects the claims for annulment, stating that: “It is evident that the Plaintiff has no grounds for requesting the annulment of Resolution RSINAC-CONAC-29-2019, which made official the boundaries of Parque Nacional Marino Las Baulas de Guanacaste, since opinion C-444-205 of 16 de setiembre de 2005, which mentions the term upstream waters (aguas arriba), is binding upon SINAC and MINAE.
Likewise, the Plaintiff has no grounds for requesting the annulment of the certifications issued by SINAC, since they are issued at the request of the interested party. They indicate whether the properties are located within or outside the boundary of a protected wildlife area (área silvestre protegida), and Article 37 of Ley Orgánica del Ambiente N° 7554 indicates that, until expropriation or purchase occurs, they are not part thereof, as does the law creating Parque Nacional Marino Las Baulas.” It then invokes Articles 32 and 37 of Ley Orgánica del Ambiente and, regarding the legal history of the creation of PNMB and the Management Plan (Plan de Manejo) prepared by SINAC, states: “(...) Parque Nacional Marino Las Baulas de Guanacaste was created by Decreto Ejecutivo Nº 20518-MIRENEM, of 5 de junio de 1991, published in La Gaceta Nº 129 of 09 de julio de 1991, and was ratified by Ley Nº 7524, of 10 de julio de 1995, published in La Gaceta Nº 154 of 16 de agosto de 1995.
The principal purpose of its creation was to protect the nesting areas of the leatherback turtle (Dermochelys coriacea), the mangroves, and the marine-coastal ecosystems of Bahía de Tamarindo. Ley N° 7524, which created the aforementioned park, provides, in relevant part: ‘Article 2.- Expropriations. To comply with this Law, the competent institution shall pursue the expropriation of all or part of the properties located within the area delimited in the preceding article. The privately owned lands within that delimitation shall be subject to expropriation and shall be considered part of Parque Nacional Marino Las Baulas once they have been acquired by the State through purchase, donations, or expropriations; until then, the owners shall fully enjoy the rights inherent in ownership. The General Management Plan (Plan General de Manejo) of Parque Nacional Las Baulas, as a planning instrument, includes zoning-based planning that makes it possible to guide the management of a protected wildlife area toward achieving its long-term conservation objectives, within the areas incorporated into the State Natural Heritage (Patrimonio Natural del Estado) inside the protected wildlife area, while the regulations serve to fulfill the objectives for which it was created and conserved.
Furthermore, through Resolution R-SINAC-CONAC-114-2017, the General Management Plan of Parque Nacional Marino Las Baulas for the 2017/2026 period was updated and approved, and the Executive Summary of the Management Plan of Parque Nacional Marino Las Baulas de Guanacaste was published for the purpose of making it official in La Gaceta No. 281, of 21 de noviembre de 2017. It has the following objectives: a) Conservation Objectives of Parque Nacional Marino Las Baulas: To protect the populations of leatherback turtles (Dermochelys coriacea) that nest at playa Grande, Ventanas and Langosta, as well as other species of sea turtles that reproduce at the site, such as the olive ridley turtle (Lepidochelys olivacea) and the Pacific black turtle (Chelonia mydas agassizii). It also protects the Tamarindo, San Francisco and Ventanas estuaries and their mangroves, the coastal tropical dry forest, and the intertidal, neritic and oceanic ecosystems. b) Objective of the Management Plan: To implement and coordinate the strategic guidelines necessary to consolidate the conservation of PNMLB and achieve effective management of the protected wildlife area.’” Then, regarding the expropriation of the properties mentioned by the plaintiff, it asserts that: “It is important to state that, of the 22 properties belonging to the plaintiff that are named in the first allegation of fact, SINAC initiated expropriation proceedings, together with the corresponding declarations of public interest, for only four of them (Properties numbers 5-42330, 5-42332, 5-42334 and 042336).
This occurred at a time when SINAC had not yet received report DFOE-PGAA-IF-3-2010 from the Contraloría General de la Republica, in which it was informed of and issued technical directives with which it must comply in order to continue the expropriation proceedings in the National Park. It is therefore concluded that, although the aforementioned properties owned by GRANDE BEACH HOLDINGS LDTA Y WINDWS BLUE SKY NCT SOCIEDAD ANONIMA, all registration entries for which appear in the first allegation of fact in the complaint at issue, have not been expropriated, those companies are not subject to restrictions on the administration, use and enjoyment of their aforementioned properties, provided that they comply with all current environmental regulations.”- At the oral trial, the following was stated, in essence, at the beginning of the proceedings and in the closing arguments: On behalf of the co-plaintiff companies: A Decree is being applied over a Law, and the former is being applied over the latter on the basis of a mere technical opinion.
Subsequently, based on 2 opinions and a decree, the Procuraduría General de la República (hereinafter, “PGR”) interprets and shifts the boundaries, leaving eight properties within the boundaries of Parque Nacional Marino Las Baulas. The theory of the case is that they lie outside the boundaries of the park established by Law. No opinion, legal interpretation or decree may take precedence over the Law. The interpretation must be based on the “seaward waters” (aguas adentro) criterion. In the alternative, expropriation should be ordered. On behalf of the State: The purpose of the action is to annul the SINAC resolution because it is based on PGR opinion 454. In all the proceedings that have taken place, the concept of “seaward waters” must be disapplied, and the Law establishes that expropriation must occur. Ever since the 1991 decree creating the park, the 125 meters measured from the ordinary high-tide line (pleamar ordinaria) had already been included, and it could not subsequently remove that area from protection; this confirms that fact.
Buildings and residential developments would affect turtle nesting and defeat the purpose of the park. All successive legal actions have sought the annulment of the opinion, and those claims have been rejected. PGR’s interpretation is based on natural features. The issue raised has been whether the properties fall within the boundaries established by the Administration. There are no grounds whatsoever for annulment. There are no grounds for expropriation, but it was determined that many parent properties (fincas madres) had been improperly registered because they encompassed the Maritime-Terrestrial Zone (Zona Marítima Terrestre), and it was necessary to determine which properties were registered; moreover, the appraisals were inflated, and there were various other problems. Expropriation cannot be ordered because no studies have been conducted, and therefore expropriation is not appropriate.
On behalf of SINAC: The PGR opinion merely interprets the Law and does not go beyond its content. CONAC’s application of the resolution concerning the boundaries is purely an act of implementation. The Maritime-Terrestrial Zone is excluded from its application because it is part of the national park. The law ratifying Parque Marino Baulas calls for the expropriation of lands that form part of the park. The authority of what is now INDER cannot be used to register properties because it has no judicial authority. With regard to the location of the land, it will be shown that the survey plats (planos) of the plaintiffs’ properties lie within the park boundaries. The boundaries have been established in other proceedings. The principle of non-regression (principio de no regresión) in environmental matters must be applied.- V) ON THE MERITS: History of the creation of Parque Nacional Marino Las Baulas: Article 13 of Ley del Servicio de Parques Nacionales (N° 6084 of 24 de agosto de 1977) states: “The Servicio de Parques Nacionales shall be responsible for proposing to the Executive Branch the creation of new national parks.// They shall be established by executive decree, which shall state, with complete precision, the boundaries previously designated by the Instituto Geográfico de Costa Rica.
These boundaries may be changed only by law” (underlining added).- Under that statutory authority, the Executive Branch issued Decreto Ejecutivo N° 20518 of 5 de junio de 1991, which created PNMB with the boundaries and conditions established in Articles 1, 2 and 3, which provide as follows (underlining added):
“Article 1°- Parque Nacional Marino Las Baulas de Guanacaste is hereby created, with the following boundaries, according to the Villareal and Matapalo 1:50,000-scale map sheets of the Instituto Geográfico Nacional.
Starting from a point located at the southern end of Playa Ventanas, the boundary follows a straight line bearing N 45 X E for a distance of 125 meters from the ordinary high-tide line. It continues along an imaginary line parallel to the public zone (zona pública) and 75 meters from it, in a southeasterly direction to the point with coordinates N 255.000 and E 335.050.
This national park shall also encompass the Ventanas estuary and its mangroves, the hill immediately behind Punta Ventanas, Punta Carbón, Isla Capitán, and the public zone located between Punta Conejo and the southern end of Playa Langosta up to the ordinary high-tide line.” “Article 2°- The beaches of Carbón and Ventanas, including a strip of land measuring 75 meters from the public zone, are hereby declared a protective zone (zona protectora) named Las Baulas de Guanacaste. All residential developments and developments of any other kind undertaken in this zone must receive the approval of the Ministerio de Recursos Naturales, Energía y Minas.” “Article 3°- Within the boundaries of the National Park, the provisions and prohibitions established for national parks in Ley N° 6084 of 24 de agosto de 1977 shall apply, and within the boundaries of the protective zone, the provisions of Ley N° 7174 of 28 de junio de 1990 shall apply.” Although Parque Nacional Marino Las Baulas is, as its name states, a “marine” park, it is not true that it covered only the sea; rather, it also includes a small inland area extending 125 meters from the ordinary high-tide line.
Article 1 refers to 125 meters measured from the ordinary high-tide line, while Article 2 refers to 75 meters measured from the public zone, which, it should be recalled, extends 50 meters from the ordinary high-tide line pursuant to Articles 9 and 10 of Ley de la Zona Marítima Terrestre (N° 6043 of 2 de marzo de 1977), amounting to the same 125 meters measured from that line. Furthermore, as a matter of elementary logic, if what is being protected is the nesting of the leatherback turtle, that natural event does not occur in the sea but on the beach—that is, on dry land—and therefore that territory must also be protected. It should be recalled that these latter provisions state as follows (underlining added):
“Article 9º.- The maritime-terrestrial zone (zona marítimo terrestre) is the two-hundred-meter-wide strip extending along the entire Atlantic and Pacific coasts of the Republic, regardless of its nature, measured horizontally from the ordinary high-tide line, as well as the land and rocks exposed by the sea at low tide.
For all legal purposes, the maritime-terrestrial zone includes islands, islets and sea rocks, as well as all land or natural formations rising above ocean level within the territorial sea of the Republic. Isla del Coco is excepted and shall remain under the direct ownership and possession of the State, as are any other islands whose ownership or administration is determined in this law or in special laws.” "Article 10.- The maritime-terrestrial zone (zona marítimo terrestre) consists of two sections: the PUBLIC ZONE (ZONA PUBLICA), which is the fifty-meter-wide strip measured from the ordinary high-tide line, together with the areas exposed at low tide; and the RESTRICTED ZONE (ZONA RESTRINGIDA), consisting of the remaining one-hundred-and-fifty-meter strip, or of the other lands in the case of islands.
The islets, rocks, and other small areas and natural formations protruding from the sea belong to the public zone." Following the issuance of the Executive Decree, Law No. 7524 of July 10, 1995, entitled "Creación del Parque Nacional Marino Las Baulas de Guanacaste," was enacted. It established, in the highest-ranking legislation (ordinary law), the creation and boundaries of PNMB, setting forth its boundaries in Article 1 as follows: "The Parque Nacional Marino las Baulas de Guanacaste is hereby created, and its boundaries, according to the Villarreal and Matapalo map sheets at a scale of 1:50.000 of the Instituto Geográfico Nacional, shall be as follows: beginning at a point located at coordinates N 259.100 and E 332.000, it follows a straight line until reaching an imaginary line parallel to the coast, located one hundred twenty-five meters seaward from the ordinary high-tide line. Along this imaginary line, the boundary continues in a southeasterly direction until ending at the point with coordinates N 255.000 and E 335.050.
The Park shall also encompass the Tamarindo, Ventanas, and San Francisco estuaries and their mangroves; the hill located immediately behind playa Ventanas; cerro El Morro; isla Capitán; isla Verde; the fifty-meter public zone, measured from the ordinary high-tide line, between punta San Francisco and estero San Francisco; and the territorial waters of bahía Tamarindo, lying between punta Conejo and the southern end of playa Langosta, up to the ordinary high-tide line" (underlining added).- Now, the crux of the matter in this case is that a comparison of the boundaries established by Executive Decree No. 20518 of June 5, 1991, and Law No. 7524 of July 10, 1995, shows that the Decree states that the landward boundary is 125 meters inland from the ordinary high-tide line, whereas the Law states that the boundary is 125 meters seaward from the ordinary high-tide line. This is precisely the point of disagreement between the plaintiffs, on the one hand, and the State and SINAC, on the other, because, as seen in the section on proven facts, if the PNMB boundary were located in the sea, none of the properties registered in the names of the plaintiff companies would be within the park.- Finally, there is a practical consideration, because protection is provided on account of turtles nesting on the beach, and therefore protection makes sense only if it extends inland.
The argument that turtles now rarely reach the beaches protected by the park must also be rejected, because the national park (both terrestrial and marine) was created 22 years ago precisely to prevent that outcome, and it may be questioned whether the failure to complete the acquisition of the lands located within the park has contributed to the sharp decline in the population of that wildlife species.- In view of the foregoing, this Court finds that the inclusion in Article 1 of the cited Law of the expression implying that the boundaries lie 125 meters seaward is inconsistent not only with the coordinates and perimeter stated in the same provision, but also with the Executive Decree that initially created the national park. The term "seaward" must therefore be understood as foreign to and inconsistent with the remainder of that Article 1, as well as inconsistent with the Executive Decree establishing that PNMB extended 125 meters inland from the ordinary high-tide line.- Given the foregoing contradiction within Article 1 of Ley 7524, and between this later, higher-ranking provision and Executive Decree 20518, this Court must resolve two questions: whether the Law tacitly repealed or amended the Executive Decree with respect to the area of PNMB; and how the evident contradiction within Article 1 should be interpreted.
Those questions will be addressed below.- VI) Did Ley 7524 tacitly repeal or amend Executive Decree 20518 with respect to the area of PNMB?: At first glance, under subsections c) and e) of section 1) of Article 6 of the Ley General de la Administración Pública (hereinafter, "LGAP"), it would appear that the cited Law, as a higher-ranking provision enacted later in time, tacitly repealed the aforementioned Executive Decree with respect to the terrestrial area of PNMB, because the Law states that the perimeter was located 125 meters seaward from the ordinary high-tide line, whereas the Decree stated that the perimeter would be 125 meters inland from the ordinary high-tide line.- Notwithstanding the foregoing, that appearance vanishes when it is recalled that the matter under consideration concerns environmental law and that the principle recognized by the Sala Constitucional in its binding case law (Article 13 of the Ley de la Jurisdicción Constitucional) applies: the area of a national park may be reduced only by means of a Law supported by technical studies demonstrating that protection of the areas of the national park is no longer necessary and that the reduction may be made without detriment to environmental protection.
Accordingly, due regard must be given to the Tribunal Constitucional’s holding in decision 7294-98 at 16:15 hours on October 13, 1998: "(...) In accordance with the foregoing, mutatis mutandis, if, in creating a protected wilderness area (área silvestre protectora), the Asamblea Legislativa established by law that specific requirements had to be met in order to determine whether the designation in question was justified, it logically follows that certain requirements—such as the preparation of environmental technical studies—must also be met for its partial or total removal from protected status (desafectación), in order to determine that such removal does not violate Article 50 of the Constitution. In this regard, we may speak of degrees of removal from protected status. Thus, not every removal of a protected zone from that status is unconstitutional, insofar as it does not impair or threaten the right to the environment.
It follows that, to reduce any protected wilderness area, the Asamblea Legislativa must do so on the basis of sufficient and necessary technical studies establishing that the environment will not be harmed or endangered and, consequently, that Article 50 of the Constitution will not be violated. The principle of reasonableness, as it relates to the fundamental right to the environment, requires that provisions issued concerning this matter be duly supported by serious technical studies, even if no other legal provision expressly required it. In the opinion of this Tribunal Constitucional, the requirement contained in Article 38 of Ley Orgánica del Ambiente No. 7554, to the effect that, before an area protected by formal law may be reduced, technical studies justifying the measure must be conducted, is simply the concrete embodiment of the principle of reasonableness in environmental protection.// V.- It must also be emphasized, as noted above, that, to give effect to and comply with Article 50 of the Constitución Política, it is not enough for public authorities to enact environmental protection measures.
It is also essential that, in exercising their duties, those same officials refrain from issuing acts inconsistent with that constitutional mandate, as occurred with the provision whose constitutionality is under review, which, having been approved through a procedure omitting a substantive requirement imposed by a law then in force, provides for the reduction of an area declared to be a protected zone (...)" (underlining added).- Accordingly, the answer to the question presented is that, although there is a contradiction between the Law and the Executive Decree concerning the perimeter of PNMB, that Law cannot be applied on this point because it conflicts with Article 50 of the Constitution and the cited binding constitutional case law.- VII) How should the evident contradiction within Article 1 of Ley 7524 be interpreted?: Without prejudice to the foregoing, it is also true that the provision under discussion contains an evident contradiction between the stated reference points and coordinates and the expression "located one hundred twenty-five meters seaward from the ordinary high-tide line," and the remainder of the text, which identifies numerous places and various coordinates consistent with the Executive Decree’s provision that PNMB would also include an area with a perimeter 125 meters inland from the ordinary high-tide line.- The question must be answered by stating that, where a contradiction exists within a single provision, that provision must be interpreted in light of the environmental-protection principle of Article 50 of the Constitution.
The expression "located one hundred twenty-five meters seaward from the ordinary high-tide line" must be treated as inapplicable, and the remainder of the provision must be applied consistently with the perimeter of the national park already created by the Executive Decree.- VIII) Based on the foregoing premises, the principal claims in the action may now be decided, namely:
In the Court’s view, this prayer for relief cannot be granted because the reasoning in that document makes clear that PNMB is considered to include a terrestrial area. It is evident that the definition of 125 meters inland from the ordinary high-tide line, derived from the 1991 Executive Decree, was applied, rather than the definition of 125 meters seaward from the ordinary high-tide line, derived from the 1995 Law. That application is correct because this marine national park includes mainland areas, as reflected in the first group of coordinates under the subheading: "Terrestrial Sector 1 (Cerro Morro, Estero Ventanas, Cerro Ventanas, 125 m Strip, and Estero Tamarindo Sectors—Beginning at punta Conejo)." The reasons why this application of the law is correct were set forth in the preceding recitals (considerandos).- For the same reason, the third principal claim, which states as follows, must be denied:
This is because, when PNMB was created to include not only marine territory but also mainland territory, the rights inherent in private property were restricted mandatorily and with binding effect, rather than voluntarily as claimed here. The voluntary application of a protection regime to registered inland lands is incompatible with the existence of the national park.- With respect to the second principal prayer for relief, consisting of:
this Chamber finds it inadmissible, first, because the SINAC certifications stating that 7 properties registered in the name of Grande Beach Holdings Limitada lie wholly or partially within PNMB (images 44-50) assess only those 7 parcels. There is no certification for the remaining 15 properties registered in the names of the co-plaintiffs; it is therefore false that the remaining 15 properties are in any way affected by the legally established boundaries of PNMB.- Second, the plaintiffs submitted no useful evidence to establish that the certifications referenced in the list of proven facts (hechos probados) were inconsistent with reality. Indeed, as noted in the first unproven fact (hecho no probado), the private topographic expert report (pericia topográfica privada) submitted by the plaintiffs, prepared by surveyors Yordy Blanco Ortega and Norman Blanco Faerron (images 52-65), is technically invalid for the simple reason that, in establishing the perimeter of the PNMB, it relied on the definition of 125 meters seaward from the ordinary high-tide line set forth in the 1995 Law, rather than the correct definition of 125 meters inland under the 1991 Executive Decree.
In that regard, at minutes 54 and 55 of the recording of the oral trial, Engineer Yordy Blanco made clear which boundaries were used in his expert report, thereby invalidating his entire study and, obviously, its conclusions.- In any event, the certifications were issued after the SINAC National Council of Conservation Areas issued resolution R-SINAC-CONAC-29-2019 of 12 de diciembre del 2018, entitled “Official Establishment of the Boundaries of Parque Nacional Marino Las Baulas de Guanacaste,” and those certifications were issued on the basis of the 1991 Executive Decree, the 1995 Law, and those official boundaries. Thus, as a matter of logic, since the aforementioned SINAC resolution was not successfully invalidated, the challenged certifications likewise cannot be invalidated as contrary to law. It should be noted that although the document prepared by SINAC surveyor Fabián Bonilla Salguero (official letters ACT-OR-T-482-2022 of 2 de mayo del 2022 and ACT-OR-T-432-2022 of that same date, at images 203-211) does use the correct PNMB boundaries, it does not establish that the parcels registered in the plaintiffs’ names are located within the park’s perimeter.
This is because it was submitted to rebut the private expert report filed with the complaint, rather than specifically to establish the status of the parcels, and because it did not even correlate or cross-reference the cadastral plans (planos catastrados) with the registered property numbers, making it impossible for the document to demonstrate whether the title to the property actually covers the same land shown on the plan.- IX) The alternative claims for relief (pretensiones subsidiarias) must next be decided, as follows:
This other claim for relief (extremo petitorio) cannot be granted, in the opinion of this Chamber. First, the creation, existence, and established perimeter of the PNMB do not affect all 22 properties registered in the names of the plaintiffs herein; rather, they affect only a group of seven properties belonging to Grande Beach Holdings Limitada, specifically the following:

In this regard, it should also be noted that the plaintiffs acquired all the properties after the Park was created by the 1991 Executive Decree (the acquisitions occurred in 2003, 2005 and 2007). It was therefore clear that land at the site would be purchased and expropriated to form part of the PNMB, and it cannot be claimed that this future restriction on property rights could not materialize.- Third, no de facto expropriation can be recognized because both Article 37 of the Ley Orgánica del Ambiente and section 2 of the Law creating the PNMB establish that privately owned land located within national parks will remain private until the State pays the corresponding expropriation amount, which has not occurred in this case.- Because these two claims are connected, they must be analyzed jointly and, in the Tribunal’s view, they should be granted. It should be borne in mind that although Article 2 of the Law creating the PNMB establishes that the State may deem property located within the park’s perimeter to have been incorporated only after it pays the expropriation amount, it is unreasonable that, more than 33 years after the park was created by the 1991 Decree, the expropriation of the land needed to complete the consolidation of the protected area has not been concluded.
The Sala Constitucional reached the same conclusion in judgment N° 2008007549 of 17:38 hours on 30 de abril del 2008, which constitutes binding precedent (precedente de carácter vinculante) not only for this Tribunal but for every person or entity (the rule set forth in Article 13 of the Ley de la Jurisdicción Constitucional). This Chamber considers that delay entirely unacceptable, and because this ordinary proceeding (proceso ordinario) challenges the Administration’s failure to act in processing those proceedings, relief must be granted. Likewise, in this case there is actual pecuniary damage (daño patrimonial efectivo) that must be compensated, arising from lawful conduct and a special adverse impact on the latter company, under Articles 194 and 196 LGAP.- Accordingly, the Executive Branch must be ordered, within three months after this judgment becomes final, to process the Decree declaring the properties to be in the public interest (declaratoria de interés público) and communicate the administrative appraisal (avalúo administrativo) concerning the seven foregoing properties to the legal representatives of Grande Beach Holdings Limitada.
Any unjustified delay in carrying out those actions may be raised before the enforcement judge (juez de ejecución) of this Tribunal for appropriate action. If the parties whose properties are being expropriated object to the appraisal, the Ministerio de Ambiente, through the Procuraduría General de la República, must initiate judicial expropriation proceedings (proceso judicial expropiatorio) as promptly as possible to establish just compensation (justiprecio), as provided in the Ley de Expropiaciones.- It must be noted that no compensation may be awarded for land forming part of the maritime-terrestrial zone (zona marítimo terrestre)—whether the public zone (zona pública), 50 meters from the ordinary high-tide line, or the restricted zone (zona restringida), between 50 and 200 meters from the ordinary high-tide line—where the aforementioned company holds no concession under the applicable Law (see the certifications referenced in the proven facts), or for property forming part of the Patrimonio Natural del Estado, such as mangroves.
Furthermore, if it is shown that such land was initially registered unlawfully, in violation of the applicable legal framework, the corresponding compensation may not be ordered because the land was unlawfully removed from the public domain (demanio público). All of this may also be reviewed by the enforcement judge upon a party’s application.- As to the claim seeking indexation (indexación), the request regarding the expropriation compensation amount must be denied, as that issue must be litigated in the special proceeding for determining just compensation (proceso especial de justiprecio) under the Ley de Expropiaciones. It should be recalled that no amount is being awarded in this proceeding as damages, because that issue likewise was not the subject of any claim.- X) This case has two particular features regarding costs (costas): 1) both plaintiff companies acted through the same legal representation, although only one of them prevailed on two alternative claims; and 2) pursuant to Article 12 CPCA, SINAC participated in this proceeding together with the State, even though no claim was asserted directly against that decentralized body with instrumental legal personality (órgano desconcentrado con personalidad jurídica instrumental) in connection with the performance of its own functions.- It must also be noted that most of the claims were denied and only the claim seeking an order for the expropriation of a small number of properties was granted.
There was thus partial success by each side (vencimiento recíproco), because although several claims were granted, most were denied as manifestly unfounded, making section 73.2.3 of the Código Procesal Civil applicable (applicable to this matter pursuant to Article 220 CPCA).- Consequently, each party must bear its own costs.- XI) In accordance with the foregoing, the defense of lack of legal entitlement (excepción de falta de derecho) must be partially sustained with respect to the denied claims and rejected with respect to the claims for relief that were granted.-

It is hereby noted that no compensation may be awarded for land forming part of the maritime-terrestrial zone (zona marítimo terrestre) (both the public zone—50 meters from the ordinary high-tide line—and the restricted zone—between 50 and 200 meters from the ordinary high-tide line—), in which the aforementioned company holds no concession under the applicable law; nor may compensation be awarded for property forming part of the State’s Natural Heritage (Patrimonio Natural del Estado).
Likewise, if it is shown that such land was registered in violation of the legal system, the corresponding compensation may not be ordered because it was unlawfully removed from the public domain (demanio público). "Artículo 1°- Créase el Parque Nacional Marino Las Baulas de Guanacaste, cuyos límites serán las siguientes, según las hojas cartográficas Villareal y Matapalo escala 1:50,000 del Instituto Geográfico Nacional.
Partiendo de un punto ubicado en el extremo sur de Playa Ventanas, sigue por una línea recta con orientación N 45 X E, y una distancia de 125 metros desde la pleamar ordinaria. Continúa el límite por una línea imaginaria paralela a la zona pública y distante de la misma 75 metros, con dirección sureste hasta el punto de coordenadas N 255.000 y E 335.050.
Este parque nacional abarcará también el estero Ventanas y sus manglares, el cerro inmediatamente atrás de Punta Ventanas, la Punta Carbón, la Isla Capitán, la zona pública localizada entre Punta Conejo y el extremo sur de Playa Langosta hasta la línea de pleamar ordinaria" "Artículo 2°- Se declara a las playas Carbón y Ventanas, incluyendo una franja de terreno de 75 metros, contada a partir de la zona pública, como zona protectora denominada Las Baulas de Guanacaste. Todos los desarrollos habitacionales y de cualquier otra índole que se hagan en esta zona, deberán contar con la aprobación del Ministerio de Recursos Naturales, Energía y Minas" "Artículo 3°- Dentro de la demarcación del Parque Nacional, regirán las disposiciones y prohibiciones establecidas para los parques nacionales en la ley N° 6084 del 24 de agosto de 1977 y dentro de la demarcación de la zona protectora regirán las disposiciones de la ley N° 7174 del 28 de junio de 1990" Ahora bien, si bien el nombre del Parque Nacional Marino Las Baulas, como su nombre lo dice es "marino", no es cierto que cubriera únicamente el mar, sino que también hay una pequeña área tierra adentro de 125 metros a partir de la línea de pleamar ordinaria que también lo integra.
Véase que en el artículo 1 habla de 125 metros a partir de la línea de pleamar ordinaria y el numeral 2 habla de 75 metros a partir la zona pública, que debemos recordar que de conformidad con los artículos 9 y 10 de la Ley de la Zona Marítima Terrestre (N° 6043 del 2 de marzo de 1977), es de 50 metros a partir de la línea de pleamar ordinaria, o lo que es lo mismo 125 metros de esa misma línea. Además, por razones de elemental lógica, si lo que se protege es el desove de la tortuga Baula, ese hecho de la naturaleza no se da en mar sino en la playa, esto es en tierra firme ese territorio también debe estar protegido. Recuérdese que estas últimas normas dicen (los subrayados son propios):
"Artículo 9º.- Zona marítimo terrestre es la franja de doscientos metros de ancho a todo lo largo de los litorales Atlántico y Pacífico de la República, cualquiera que sea su naturaleza, medidos horizontalmente a partir de la línea de la pleamar ordinaria y los terrenos y rocas que deja el mar en descubierto en la marea baja.
Para todos los efectos legales, la zona marítimo terrestre comprende las islas, islotes y peñascos marítimos, así como toda tierra o formación natural que sobresalga del nivel del océano dentro del mar territorial de la República. Se exceptúa la Isla del Coco que estará bajo el dominio y posesión directos del Estado y aquellas otras islas cuyo dominio o administración se determinen en la presente ley o en leyes especiales" "Artículo 10.- La zona marítimo terrestre se compone de dos secciones: la ZONA PUBLICA, que es la faja de cincuenta metros de ancho a contar de la pleamar ordinaria, y las áreas que quedan al descubierto durante la marea baja; y la ZONA RESTRINGIDA, constituida por la franja de los ciento cincuenta metros restantes, o por los demás terrenos en caso de islas.
Los islotes, peñascos y demás áreas pequeñas y formaciones naturales que sobresalgan del mar corresponden a la zona pública" Posteriormente a la emisión de Decreto Ejecutivo, se emitió la Ley N° 7524 del 10 de julio de 1995, denominada "Creación del Parque Nacional Marino Las Baulas de Guanacaste", que consagró en la normativa de más alto grado (la ley ordinaria), la creación y límites del PNMB, estableciéndose sus límites en el artículo 1° de la siguiente manera: "Se crea el Parque Nacional Marino las Baulas de Guanacaste, cuyos límites, según las hojas cartográficas Villarreal y Matapalo escala 1:50.000 del Instituto Geográfico Nacional, serán los siguientes: partiendo de un punto ubicado en las coordenadas N 259.100 y E 332.000, sigue por una línea recta hasta alcanzar una línea imaginaria paralela a la costa, distante ciento veinticinco metros de la pleamar ordinaria aguas adentro. Por esta línea imaginaria, continúa el límite con dirección sureste, hasta terminar en el punto de coordenadas N 255.000 y E 335.050.
El Parque también abarcará los esteros Tamarindo, Ventanas y San Francisco y sus manglares; el cerro localizado inmediatamente detrás de playa Ventanas, el cerro El Morro, la isla Capitán, la isla Verde, la zona pública de cincuenta metros, medida desde la pleamar ordinaria, entre la punta San Francisco y el estero San Francisco y las aguas territoriales de la bahía Tamarindo, comprendidas entre punta Conejo y el extremo sur de playa Langosta, hasta la línea de pleamar ordinaria" (los subrayados son propios).- Ahora bien, el quid de la cuestión en este caso es que si se comparan los límites existentes entre el Decreto Ejecutivo N° 20518 del 5 de junio de 1991 y de la Ley N° 7524 del 10 de julio de 1995, se evidencia que en el decreto se dice que el límite en tierra es de 125 metros tierra adentro desde la pleamar ordinaria y en la ley se dijo que el límite era 125 metros mar adentro desde la pleamar ordinaria.
Precisamente ese el punto de discordancia entre por un lado, los actores y por otro lado, el Estado y el SINAC, porque según lo que vimos en el apartado de hechos probados, si el límite del PNMB estuviera en el mar, ninguna de las propiedades inscritas a nombre de las sociedades actores estaría dentro del parque.- Finalmente hay un enfoque práctico, porque la protección se da en razón del desove de las tortugas en la playa, razón por la que la protección solo tiene sentido se se hace tierra adentro. También descartar el argumento de que ya casi no llegan tortugas a las playas protegidas por el parque, porque precisamente la creación del parque nacional (terrestre y marino) hace 22 años, fue para evitar eso, pudiéndose cuestionar si la falta de consolidación de la compra de las tierras ubicadas dentro del parque no ha ayudado a la fuerte reducción de la población de esa especie silvestre.- Visto lo anterior encuentra este Tribunal que inclusión en el artículo 1° de la Ley citada, de la expresión que implica que los límites esté 125 metros mar adentro, es contradictoria no solo con las coordenadas y perímetro expresados en la misma norma, sino también con el Decreto Ejecutivo que inicialmente creó el parque nacional, debiéndose entender que el concepto "aguas adentro" es ajeno y contrario al resto de ese numeral 1° y también contrario al Decreto Ejecutivo que establecía que el PNMB cubría 125 metros tierra adentro de la línea de pleamar ordinaria.- Planteada la anterior contradicción dentro del mismo artículo 1° de la Ley 7524 y de esta norma de rango superior y posterior en el tiempo con el Decreto Ejecutivo 20518, corresponde a este Tribunal dilucidar dos cuestiones: si la Ley derogó o modificó tácitamente el Decreto Ejecutivo en cuanto al área del PNMB; cómo se debe interpretar la contradicción evidente existente dentro del artículo 1°.
Eso se hará a continuación.- VI) ¿La Ley 7524 derogó o modificó tácitamente el Decreto Ejecutivo 20518, en cuanto al área del PNMB?: A primera vista en aplicación de lo dispuesto en los incisos c) y e) del apartado 1) del artículo 6 de la Ley General de la Administración Pública (en adelante, "LGAP"), parecería que la Ley citada por ser una norma de carácter superior y emitida posteriormente en el tiempo, derogó tácitamente el Decreto Ejecutivo mencionado, en cuanto el área en tierra del PNMB, por cuanto en la Ley se dice que el perímetro estaba ubicada 125 metros aguas adentro de la línea de pleamar ordinaria, cuando el Decreto decía que ese perímetro sería 125 metros tierra adentro de la línea de pleamar ordinaria.- No obstante lo anterior, esa apariencia se desvanece cuando se recuerda que tema que se analiza es la materia ambiental y es de aplicación el principio reconocido por la Sala Constitucional en su jurisprudencia de carácter obligatorio (artículo 13 de la Ley de la Jurisdicción Constitucional), que reconoce el principio que que el área de un parque nacional no puede ser reducida sino por medio de Ley que cuente con estudios técnicos, que demuestren la falta de necesidad para la protección de las áreas del parque nacional, permitiendo la disminución sin perjuicio para la protección ambiental.
Así, debe tenerse presente lo dicho por el Tribunal Constitucional por el voto 7294-98 de 16:15 horas del 13 de octubre de 1998: "(...) De acuerdo con lo citado, mutatis mutandi, si para la creación de un área silvestre protectora la Asamblea Legislativa, por medio de una ley, estableció el cumplimiento de unos requisitos específicos, a fin de determinar si la afectación en cuestión es justificada, lo lógico es que, para su desafectación parcial o total, también se deban cumplir determinados requisitos -como la realización de estudios técnicos ambientales- para determinar que con la desafectación no se transgrede el contenido del artículo 50 constitucional. En este sentido, podemos hablar de niveles de desafectación. Así, no toda desafectación de una zona protegida es inconstitucional, en el tanto implique menoscabo al derecho al ambiente o amenaza a éste. De allí que, para reducir un área silvestre protegida cualquiera, la Asamblea Legislativa debe hacerlo con base en estudios técnicos suficientes y necesarios para determinar que no se causará daño al ambiente o se le pondrá en peligro y, por ende, que no se vulnera el contenido del artículo 50 constitucional.
El principio de razonabilidad, en relación con el derecho fundamental al ambiente, obliga a que las normas que se dicten con respecto a esta materia estén debidamente motivadas en estudios técnicos serios, aún cuando no existiera otra normativa legal que así lo estableciera expresamente. A juicio de este Tribunal Constitucional, la exigencia que contiene el artículo 38 de la Ley Orgánica del Ambiente No. 7554, en el sentido de que para reducir un área silvestre protegida por ley formal deben realizarse, de previo, los estudios técnicos que justifiquen la medida, no es sino la objetivación del principio de razonabilidad en materia de protección al ambiente.// V.- Debe rescatarse además, como se señaló líneas arriba, que para otorgar vigencia y cumplir con el numeral 50 de la Constitución Política no basta que las autoridades públicas dicten medidas protectoras del ambiente. También es indispensable que en ejercicio de sus cargos esos mismos funcionarios no emitan actos contradictorios con el citado postulado constitucional, tal y como sucede con referencia a la norma cuya constitucionalidad se examina, la cual, aprobada mediante un procedimiento en que se omite un requisito sustancial, exigido por una ley vigente, establece la reducción de una superficie declarada como zona protectora (...)" (los subrayados son propios).- Conforme con lo anterior, la respuesta a la interrogante planteada es que si bien existe una contradicción entre la Ley y el Decreto Ejecutivo, en cuanto al perímetro del PNMB, esa ley no puede ser aplicada en ese punto por contradecir el artículo 50 constitucional y la jurisprudencia constitucional vinculante citada.- VII) ¿Cómo se debe interpretar la contradicción evidente existente dentro del artículo 1° de la Ley 7524?: Sin perjuicio de lo anterior, también lo cierto es que si se observa la norma de comentario, existe una contradicción evidente entre los puntos de referencia y las coordenadas señaladas y la expresión "distante ciento veinticinco metros de la pleamar ordinaria aguas adentro", y el resto del texto en que se señalan muchos lugares e varias coordenadas, que son coherentes con lo que establecía el Decreto Ejecutivo, en el sentido que el PNMB incluiría también un área con perímetro 125 metros tierra adentro de la línea de pleamar ordinaria.- La pregunta se debe contestar afirmando que si existe una contradicción en una misma norma, debe ser interpretada a la luz del principio de protección ambiental del artículo 50 constitucional, entendiéndose por desaplicada la expresión "distante ciento veinticinco metros de la pleamar ordinaria aguas adentro", aplicando el resto de la norma de forma coherente con el perímetro del parque nacional ya creado en el Decreto Ejecutivo.- VIII) Partiendo de los anteriores supuestos, cabe resolver las pretensiones principales de la acción; a saber:
Este extremo petitorio no es de recibo según estima el Tribunal, porque si se observa ese documento, en su fundamentación se deja claro que se considera que el PNMB tiene un área terrestre, evidenciándose que se aplicó la definición 125 metros tierra adentro a partir de la línea de pleamar ordinaria derivado del Decreto Ejecutivo de 1991 y no la definición 125 metros metros aguas adentro de la línea de pleamar ordinaria derivada de la Ley de 1995, siendo esa la aplicación correcta porque este parque nacional marino, contempla áreas en tierra firme, plasmándose esa aplicación en el primer grupo de coordenadas en el subtítulo: "Sector terrestre 1 (Sectores Cerro Morro, Estero Ventanas, Cerro Ventanas, Franja de 125 m y Estero Tamarindo-Inicia en punta Conejo)". La fundamentación porque esta esa aplicación normativa es correcta se hizo en los considerandos anteriores.- Por la misma razón anterior, se debe rechazar la tercera pretensión principal que dice:
Lo anterior porque en el momento en que se crea el PNMB que no solamente incluye territorio marino sino también en tierra firme, se limitan los atributos de la propiedad privada de forma obligatoria y vinculante y no voluntaria, como aquí se pretende, siendo excluyente la aplicación voluntaria de un régimen de protección para las tierras inscritas tierra adentro con la existencia del parque nacional.- En cuanto al segundo extremo petitorio principal, consistente en:
estima esta Cámara que es improcedente primero porque las certificaciones del SINAC en el sentido que 7 fincas inscritas a nombre de Grande Beach Holdings Limitada están comprendidas total o parcialmente dentro del PNMB (imágenes 44-50), solo valoran a esos 7 terrenos, no existiendo certificación para el resto de 15 fíncas inscritas a nombre de las coactoras, siendo falso entonces que para el resto de 15 propiedades exista afectación alguna por los límites jurídicamente establecidos para el PNMB.- En segundo término, la parte actora no presentó prueba alguna útil para establecer que esas certificaciones que se reseñan en el elenco de hechos probados, fueran contrarias a la realidad porque incluso tal como se vio en el primer hecho no probado, la pericia topográfica privada presentada realizada por los actores, realizada por los los topógrafos Yordy Blanco Ortega y Norman Blanco Faerron (imágenes 52-65), se invalida técnicamente por la simple y sencilla razón que se tomó en cuenta para establecer el perímetro del PNMB, la definición 125 metros aguas adentro de la línea de pleamar ordinaria establecida en la Ley de 1995 y no la definición correcta de 125 metros tierra adentro del Decreto Ejecutivo de 1991.
En ese sentido en los minutos 54 y 55 de la grabación del juicio oral, el Ingeniero Yordy Blanco dejó claro cuál era los límites usados en su pericia, invalidando todo su estudio y obviamente sus conclusiones.- En todo caso las certificaciones fueron emitidas posteriormente a que el Consejo Nacional de Áreas de Conservación del SINAC emitiera la resolución R-SINAC-CONAC-29-2019 del 12 de diciembre del 2018 titulado "Oficialización de los límites del Parque Nacional Marino Las Baulas de Guanacaste" y es con base en el Decreto Ejecutivo de 1991, la Ley de 1995 y esos límites oficiales que se emitieron esas certificaciones. Así, por una cuestión lógica, si no se logró invalidar la resolución del SINAC mencionada, tampoco se podrá invalidar por ser contraria a derecho, las certificaciones cuestionadas. Cabe acotar que si en el documento realizado por el topógrafo Fabián Bonilla Salguero del SINAC (oficios ACT-OR-T-482-2022 del 2 de mayo del 2022 y ACT-OR-T-432-2022 de esa misma fecha a imágenes 203-211), si bien sí utiliza los límites correctos del PNMB, no sirve para probar que los terrenos registrados a nombre de las actoras están ubicados dentro del perímetro del parque, porque fue presentado con el fin de desvirtuar la pericia privada presentada junto con la demanda y no propiamente probar la situación de los terrenos, además que ni siquiera realizó la relación o referencia entre los planos catastrados y el número de finca inscrita, siendo imposible que sirvan para demostrar si efectivamente el título de propiedad contempla los mismos terrenos establecidos en el plano.- IX) Luego se deben resolver las pretensiones subsidiarias de la acción; a saber:
Esta otro extremo petitorio no es de recibo según criterio de esta Cámara. Primero, porque no se está afectando la totalidad de las 22 propiedades inscritas a nombre de las aquí actoras, con la creación, existencia y el perímetro establecido para el PNMB sino que únicamente están afectando un grupo de siete propiedades de Grande Beach Holdings Limitada, específicamente las siguientes:
N° finca N° plano Porcentaje del lote dentro del PNMB (%) N° certificación y fecha (emitido por SINAC-Ärea Conservación Tempisque) N° imagen 42711-000 G-0402432-1980 55 TE-01-362-2021 del 29/06/2021 50 42713-000 G-0402433-1980 50 TE-01-378-2021 del 05/07/2021 48 42715-000 G-0402434-1980 50 TE-01-363-2021 del 29/06/2021 49 42719-000 G-0402447-1980 45 TE-01-364-2021 del 29/06/2021 47 42721-000 G-0402445-1980 40 TE-01-376-2021 del 05/07/2021 46 43069-000 G-0415023-1981 66,9 TE-01-333-2021 del 22/06/2021 44 89606-000 G-0356620-1996 100 TE-01-370-2021 del 30/06/2021 45 El resto de propiedades de la sociedad ya mencionada (11 fincas inscritas) y la totalidad de las cuatro fincas inscritas a nombre de Windows of the blue Sky Nct, Sociedad Anónima, no se probó por quien le correspondía la carga de demostrar (doctrina del numeral 41.1.1 del Código Procesal Civil, aplicable a esta materia por remisión del artículo 220 CPCA).- En segundo término, no se encuentra que se haya practicado una expropiación de hecho sobre las siete propiedades mencionadas en el cuadro anterior, en el sentido que sin seguir los procedimientos establecidos en el artículo 45 constitucional y en la Ley de Expropiaciones, el Estado se haya apoderado para sus fines de los bienes sin cumplir con el debido proceso.
En ese sentido debe observarse incluso que las fechas de adquisición por las actoras son todas posteriores a la creación del Parque por medio del Decreto Ejecutivo de 1991 (corresponden a los años 2003, 2005 y 2007), existiendo de esa forma claridad de que en el sitio se iban a comprar y expropiar terrenos que constituirían parte del PNMB, no pudiéndose alegar que esa limitación a la propiedad de carácter futuro se podía concretar.- En tercer lugar, tampoco se puede reconocer ninguna expropiación de hecho porque tanto el artículo 37 de la Ley Orgánica del Ambiente, como en el numeral 2 la Ley de creación del PNMB, establecen que los terrenos particulares ubicados dentro de parques nacionales, seguirán siendo privados hasta que se cancele por el Estado el monto que corresponda por expropiación, situación que no se ha dado en el presente caso.- Estas dos pretensiones por su conexión se deben analizar conjuntamente y según estima el Tribunal, sí son de recibo.
Téngase presente que si bien el artículo 2 de la Ley de Creación del PNMB, establece que el Estado podrá tener por integrado un bien ubicado dentro del perímetro del parque hasta que pague la expropiación, es irrazonable que pasados más de 33 años desde la creación del parque por el Decreto de 1991, no se hayan terminado de expropiar los terrenos para terminar de consolidar el área protegida. Así, lo entendió la Sala Constitucional, en una sentencia N° 2008007549 de las 17:38 horas del 30 de abril del 2008, que constituye precedente de carácter vinculante no solo para este Tribunal, sino para cualquier sujeto (doctrina del artículo 13 de la Ley de la Jurisdicción Constitucional). Estima esta Cámara que esa tardanza es del todo inaceptable y siendo que en este proceso ordinario se reclama la inercia de la Administración en tramitar dichas diligencias, debe concederse. Así también en este caso, se configura un daño patrimonial efectivo que debe ser indemnizado, por conducta lícita y especial afectación en perjuicio de la última sociedad mencionada, en los términos de los artículos 194 y 196 LGAP.- Conforme con lo anterior, se debe ordenar al Poder Ejecutivo que en plazo de tres meses posteriores a la firmeza de esta sentencia, tramite el Decreto de declaratoria de interés público y comunique el avalúo administrativo a los representantes legales de Grande Beach Holdings Limitada sobre las siete propiedades anteriores.
Cualquier retraso injustificado sobre la realización de esas gestiones podrá ser reclamado ante el juez o juez de ejecución de este Tribunal para lo de su cargo. En caso de haber oposición al avalúo por las expropiadas, el Ministerio de Ambiente a través de la Procuraduría General de la República, debe iniciar a la mayor brevedad el proceso judicial expropiatorio para establecer el justiprecio, establecido en la Ley de Expropiaciones.- Sí se debe advertir que no podrá reconocerse indemnización sobre terrenos que sean parte de la zona marítimo terrestre (tanto zona pública -50 metros de la línea de pleamar ordinaria- como zona restringida -entre los 50 y los 200 metros desde la línea de pleamar ordinaria-), donde la sociedad antecitada, no tiene ninguna concesión al amparo de la Ley correspondiente (véase las certificaciones que se reseñan en los hechos probados), ni sobre bienes parte del Patrimonio Natural del Estado, por ejemplo manglares.
Asimismo, si se demuestra que esos terrenos fueron inscritos inicialmente de forma ilegal, vulnerando el ordenamiento vigente correspondiente, no se podrá ordenar la indemnización correspondiente, por haber sido sustraidos ilegalmente del demanio público. Todo esto también podrá ser controlado por la persona juzgadora de ejecución, a gestión de parte.- En cuanto a las pretensión para que se reconozca la indexación, debe rechazarse lo solicitud sobre la suma de la indemnización por la expropiación, es tema que debe ser discutido en el proceso especial de justiprecio, al amparo de la Ley de Expropiaciones. Recuérdese que en este proceso no se está reconociendo suma alguna por concepto de daños, por ser tema que tampoco fue objeto de pretensión.- X) Este caso tiene dos particularidades en lo que respecto al tema de costas: 1) ambas sociedades actoras actuaron bajo una misma representación si bien solo a una se le reconocieron dos pretensiones subsidiarias; 2) el SINAC participó en este proceso conjuntamente con el Estado, por disposición del artículo 12 CPCA, a pesar de lo cual no había ninguna pretensión directamente dirigida contra ese órgano desconcentrado con personalidad jurídica instrumental, para el ejercicio de sus funciones propias.- Luego hay que observar que la mayoría de pretensiones fueron rechazadas y solo se aceptó la pretensión para que se ordene la expropiación de un pequeño número de fincas, existiendo de esta forma vencimiento recíproco porque si bien se declararon con lugar diversas pretensiones, la mayoría se rechazaron por ser abiertamente injustificadas, siendo de aplicación el numeral 73.2.3 del Código Procesal Civil (aplicable a esta materia de conformidad con el artículo 220 CPCA).- Consecuencia de lo anterior, cada parte debe asumir sus propias costas.- XI) Conforme con lo antes indicado, se debe acoger parcialmente la excepción de falta de derecho, en cuanto a las pretensiones rechazadas y rechazar esa defensa en cuanto a los extremos petitorios que fueron concedidos.-
Por tanto:

Se advierte que no podrá reconocerse indemnización sobre terrenos que sean parte de la zona marítimo terrestre (tanto zona pública -50 metros de la línea de pleamar ordinaria- como zona restringida -entre los 50 y los 200 metros desde la línea de pleamar ordinaria-), donde la sociedad mencionada, no tiene ninguna concesión al amparo de la Ley de la materia, ni tampoco podrán indemnizarse bienes parte del Patrimonio Natural del Estado.
Asimismo, si se demuestra que esos terrenos fueron inscritos vulnerando el ordenamiento jurídico, no se podrá ordenar la indemnización correspondiente, por haber sido sustraidos ilegalmente del demanio público. Cualquier retraso injustificado sobre la realización célere de esos trámites, lo mismo que si el Estado se niega a realizar la expropiación sobre bienes que deben ser indemnizados, según esta sentencia y el ordenamiento jurídico, podrá ser reclamado y resuelto por el juez o jueza de Ejecución de este Tribunal. Se rechazan el resto de pretensiones principales y subsidiarias; 3) Cada parte debe asumir sus propias costas.
