N° 2024005331 ADMINISTRATIVE AND CIVIL COURT OF THE TREASURY (TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA), SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at one thirty-six on veinte de Agosto del dos mil venticuatro.- The Court considers the application for an interim measure filed by the State’s counsel in the plenary proceeding (proceso de conocimiento) brought by THE STATE, represented by State Attorney Natalia Aguilar Porras, bar identification number 17419, against UNIÓN DISTRIBUIDORA FERAROSSE S.A., legal entity identification number 3-101-231155, represented by its special judicial attorney-in-fact (apoderado especial judicial), Andrés A. Pérez González, bar identification number 4263.- FINDINGS OF FACT 1- By a pleading dated 23 de diciembre de 2023, the State’s counsel filed an application for an interim measure (see pleading at images 2 to 4 of the electronic court case file, interim-measure record, PDF version, descending order, hereinafter the “interim-measure case file”).- 2- In the order issued at eight twenty-three on quince de febrero de dos mil veinticuatro, the defendant company was granted a hearing on the application for interim relief.- 3- In a pleading dated 23 de febrero de 2024, counsel for UNIÓN DISTRIBUIDORA FERAROSSE S.A. opposed the application for relief under review (see images 53 to 62 of the interim-measure case file).- 4- By the order issued at fourteen forty-six on veintiséis de junio de dos mil veinticuatro, the State’s counsel was granted a hearing regarding the rebuttal evidence (contraprueba) and the request for countersecurity (contracautela) made by the defendant company.- 5- The State’s counsel submitted its reply by a pleading dated 2 de julio de 2024 (see images 74 to 76 of the interim-measure case file).- 6- The required procedural formalities have been observed, and no grounds for nullity (causales de nulidad) capable of invalidating the proceedings are apparent.-

CONSIDERING

I. PURPOSE OF THE INTERIM MEASURE

The claimant seeks an interim measure so that: “...the immediate suspension of all productive, agricultural, livestock-farming, or any other activity within the area delineated as mangrove forest (manglar) in report SINAC-ACOPAC-CH-00034-2023 be ordered, and officials of the Sistema Nacional de Áreas de Conservación be allowed unrestricted access to those areas so that they may verify compliance with that order.”

III. ARGUMENTS OF THE APPLICANT

The State’s counsel states that the likelihood of success on the merits (apariencia de buen derecho) required for granting the requested relief exists because mangrove forests form part of the coastal public domain (demanio litoral) (Corte de Casación judgment of 13:17 hrs. de 24 de febrero de 1911, recital 3; Sala de Casación, decision 121 of 16 horas del 14 de noviembre de 1979); at present, they constitute wetlands (humedales), form part of the Patrimonio Natural del Estado, and retain that status even when stripped of their original vegetation or conditions (articles 262 of the Código Civil and 2 of the Ley de Aguas; sections 13, 14, 15 of the Ley Forestal; 32 and 38 of Ley 7554; Decrees 7210, 16852, 22550 and 23247). It is asserted that, in this matter, certain mangrove forests also form part of the Refugio Nacional de Vida Silvestre Playa Hermosa-Punta Mala (report No. DRI-CTE-03-252-2018 del 29 de noviembre del 2018, image 14, is cited as evidence supporting the complaint, as is Decree No. 27210, article 1.d).

It is added that, by including mangrove forests within the concept of the public zone (zona pública) of the maritime-terrestrial zone (zona marítimo terrestre), rather than within the restricted zone (zona restringida), the legislature intended to strengthen this natural resource by granting it the highest degree of protection, freeing it from potential pressures relating to its possession and reducing the risks of deterioration or destruction. Accordingly, the State’s public interest in guaranteeing, defending, and preserving the right to a healthy and ecologically balanced environment must be weighed (Art 50 Constitución Política and 1 of the Ley Orgánica del Ambiente), and the relief sought is requested for the purpose of provisionally protecting and safeguarding the subject matter of the proceeding and the effectiveness of the judgment. The State’s counsel believes that, in the particular case of the type of property involved here, serious harm would result from delaying the protection and restoration of an ecosystem of high environmental fragility, such as a mangrove forest, and that the adoption of these measures must be analyzed through the lens of the preventive principle (principio preventivo) specific to Environmental Law (Derecho Ambiental), under which: “Prevention seeks to anticipate negative effects and ensure the protection, conservation, and proper management of resources.

Consequently, the guiding principle of prevention is based on the need to take and implement all precautionary measures to contain potential harm to the environment or human health. Thus, where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, and the activity concerned may even be postponed. This is because, in environmental matters, ex post enforcement is ineffective: once socially harmful biological consequences have already occurred, punishment may carry moral significance but is unlikely to compensate for the environmental damage caused” (Sala Constitucional. Resolution No. 1250-99 of 11 horas 24 minutos del 19 de febrero de 1999). In conclusion, it is stated that report SINAC-ACOPAC-CH-00034-2023 showed that some areas within the boundary marked as mangrove forest are used for agriculture and livestock farming. Therefore, given the failure of conciliation (conciliación), there is serious concern regarding the interests of the State, represented by counsel, because of the harm that this may cause to that coastal wetland ecosystem if adoption of the measures necessary for its protection is postponed until the proceeding concludes.

In its subsequent submissions, the State’s counsel challenges the alleged weaknesses in its evidentiary foundation and the confidentiality asserted by the defendant with respect to report SINAC-ACOPAC-CH-00034-2023, and it also opposes the imposition of countersecurity should the requested relief be granted. The State’s counsel believes that the request confirms the concern that prompted the Procuraduría General de la República to seek this interim measure, because it would demonstrate that, since the opposing party became aware of report No. SINAC-ACOPAC-CH-00034-2023, which specifically delineates the mangrove-forest area within the property, agricultural production has continued in those areas despite the party’s possession of technical information concerning their true nature and the harm being caused to the mangrove ecosystem. It concludes that the countersecurity must be denied as improper, indeterminate, unsupported by evidence, and illogical.

III. ARGUMENTS OF THE DEFENDANT

As a preliminary matter, the defendant company states its objection to report SINAC-ACOPAC-CH-00034-2023 of 19 de junio de 2023, submitted by the State’s counsel. In this regard, it contends that the cited report and the supplementary studies were prepared in connection with the parties’ discussions and within a conciliation process that, because of the nature of the subject matter of the dispute, extended over several months and even years. For that reason, pursuant to the Ley de Resolución Alterna de Conflictos y Promoción de la Paz Social, article 14, that study is strictly confidential because it is connected to the content of the preparatory activities, discussions, and partial agreements forming part of the conciliation agreement (acuerdo conciliatorio). It is added that the aforementioned report is the basis for the relief sought and, as a consequence of the foregoing, the sole item of evidence offered by the Procuraduría General de la República cannot lawfully be used in the proceeding because admitting it as support for any judicial decision would violate the strict confidentiality imposed by law in the context of conciliations.

Regarding the grounds for the proposed measure, the alleged facts are disputed and the existence of the requirements for granting it is denied. As to the likelihood of success on the merits, it is stated that the extensive presentation made by the Procuraduría General de la República in the pleading requesting the interim measure describes the constitutional, statutory, and case-law grounds for protecting the maritime-terrestrial zone and mangrove forests, but that there is no dispute on that issue. Rather, the critical issue lies in the item of evidence offered to support the factual propositions underlying the application for interim relief. As noted, that evidence consists of a report that the parties agreed to obtain in an effort to resolve the dispute within the context of the conciliation being conducted between them. It was because of that conciliation, and for no other reason, that the Programa de Humedales del Área de Conservación Pacífico Central del SINAC was asked to determine the extent of the mangrove forest within the properties that are the subject of the proceeding (6-22964-000 and 6-44956-000).

It is asserted that the evidence referenced in responding to this application for an interim measure certainly does not establish that areas within the mangrove-forest boundary are being used for agriculture, much less livestock farming, in a manner that could affect the coastal wetland ecosystem, and that the the sole reference to that circumstance appears in the conclusions section of the document prepared by Mr. Julio César Solano Durán concerning the settlement that the parties sought to finalize. To the detriment of the study invoked by the State and challenged by the respondent, it is emphasized that, when issuing an expert opinion, it is insufficient merely to state conclusions of the kind contained in the cited document; those conclusions must also rest on solid theoretical foundations and on rigorous scientific research that is intersubjectively verifiable. In this case, it is unknown whether the conclusion regarding the possible impact on the mangrove is based on observation, experience, or scientific techniques validated by the expert community—that is, in accordance with customary scientific methods; otherwise, its reliability and accuracy are unknown (NAS REPORT 2009, p. 128).

The respondent also denies the existence of urgency due to delay (peligro en la demora) and argues that there is no supporting argument, much less proof, of the danger that the mangrove ecosystem or the maritime-terrestrial zone (zona marítimo terrestre) might suffer as a result of the agricultural use of the property. It must be noted, for the court’s understanding, that this is a property operated in accordance with international standards governing the use of agrochemical products, since the entire harvest is exported and must strictly comply with international standards protecting the environment and human health. It is added that the report refers to agricultural activity without specifying the type of activity, even though substantial differences exist between the cultivation of rice—which is not carried out on the properties—and the cultivation of melons or watermelons—which is carried out on the property and does not affect the mangrove or the maritime-terrestrial zone—because the property is operated under the Global G.A.

P. scheme, which is designed to ensure that agricultural production is conducted safely and sustainably for the benefit not only of producers but also of consumers. For further information, reference is made to www.globalstd.com. The company Frutas Nuñez L C del Pacífico S. A., which is responsible for production, holds the certification issued by Global G.A. P.; therefore, the property is managed in an entirely safe and environmentally friendly manner. In support of its opposition, the respondent offers the following evidence:

REPORT DIG-TOT-INF-059-2020, prepared by Geographer Giovanni Oconitrillo Chaves, Territorial Classification Subprocess Analyst, of the Topography and Territorial Observation Department, Instituto Geográfico Nacional - Registro Nacional, on the 9th, which was offered as evidence by the Procuraduría General de la República when the complaint was filed and is included in the main case file.

Roberto Segura González requests a cadastral reconciliation (conciliación catastral) of property 106093 and its subdivisions (segregaciones), as well as the identification of any potential impacts on the Zona Marítimo Terrestre or Manglar.

Lastly, the respondent requests that, if the relief sought by the State is granted, security (cautela) be imposed to guarantee compensation for any damages and losses that may arise from the wholly unjustified restrictions imposed on such a considerable area of the property, which is commercially used for the cultivation and sale of watermelons and melons. It therefore considers that the State must provide a reasonable sum as security, based on the area of the land and as determined by the judicial authority.

IV.GENERAL CONSIDERATIONS REGARDING THE REQUIREMENTS FOR GRANTING AN INTERIM MEASURE AND ITS ESSENTIAL STRUCTURAL CHARACTERISTICS. The case law has extensively developed the purpose of interim relief (justicia cautelar), which addresses the need to guarantee the constitutional principle of prompt and effective justice by preserving the factual conditions essential for the issuance and enforcement of the judgment. In this same vein, Article 19 of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo) provides that the purpose of ordering an interim measure (medida cautelar) is to provisionally protect and guarantee the subject matter of the proceedings and the effectiveness of the judgment. Based on the foregoing and in compliance with Article 21 of the procedural provision cited above, the court must determine whether a request for an interim measure is admissible by verifying that the claim in the proceedings on the merits (proceso de conocimiento) is not frivolous or manifestly lacking in seriousness.

This entails a preliminary assessment of the merits to determine whether the case presents what legal scholarship and case law have termed a likelihood of success on the merits (apariencia de buen derecho or fumus boni iuris). The provision under analysis also permits an interim measure when the implementation or continuation of the conduct at issue in the proceedings causes serious actual or potential damage or loss. This situation has been conceptualized as urgency due to delay; accordingly, because of the length of the judicial proceedings, there must be a current, real, and objective risk that the moving party will suffer serious harm. Along the same lines, Article 22 of the Administrative Litigation Procedure Code requires the court, in light of the principle of proportionality, to balance the interests at stake: the circumstances of the private party, on the one hand, and, on the other, the public interest and the interests of third parties who may be affected by the adoption of the interim measure.

In determining whether the measure is appropriate, it is also important to consider whether the measure to be adopted possesses the following structural characteristics: 1.-) Its instrumentality and prior independence in relation to the final judgment issued in the principal proceedings, which at the same time determines the measure’s subordination or ancillary nature with respect to the principal proceedings within, or for the purposes of, which it is ordered. 2.-) Its provisional nature, insofar as its effectiveness generally ends when the judgment on the merits is issued in the principal matter or when circumstances so require. That is, its effects are contingent both on the pendency of those proceedings and, on the other hand, on the continued existence of the circumstances considered when it was adopted. These characteristics stem from its inherent susceptibility to modification or revocation (effectiveness while circumstances remain unchanged (eficacia rebus sic stantibus)). 3.-) The urgency required to avoid the risk arising from delay (peligro en la mora), a feature that justifies interim measures adopted before the action is filed (ante causam), on their face (prima facie), or without hearing the opposing party (inaudita altera parte). 4.-) Summary consideration (sumaria cognitio), meaning that such measures are adopted on the basis of an extremely abbreviated assessment by the court, without prejudging the merits of the matter and without in any way replacing the full sequence of procedural steps entailed by proceedings on the merits.-

V. REGARDING THE SPECIFIC CASE

  • a)Regarding the admissibility of Report SINAC-ACOPAC-CH-00034-2023. Having analyzed the form of the referenced document, its format, and its annexes, this Court concludes that it is not subject to the confidentiality asserted by the petitioner. The purpose of the confidentiality provisions contained in the Alternative Dispute Resolution and Promotion of Social Peace Act, particularly Article 14 thereof, is not applicable to this case or to the official communication whose consideration is challenged. First, its content does not encompass “preparatory activities, conversations, and partial agreements relating to the settlement agreement (acuerdo conciliatorio)”; on the contrary, it is a technical report setting forth the matters considered and its conclusions. It makes no reference whatsoever to the parties’ proposals or reciprocal concessions concerning the subject matter of the proceeding submitted for possible conciliation, nor does it disclose the content of preliminary negotiations or partial agreements, none of which existed in this case.

The purpose of the cited provisions is to prevent statements made in the context of a settlement or possible settlement from prejudicing, or subsequently being used against, the person making them. The document contains no information or references of that nature; accordingly, the petitioner’s objection to its admissibility as evidence to be evaluated lacks the asserted legal basis. Second, the wording and structure of the document are consistent with the assertion by the Office of the Attorney General that it was prepared for use in defending the State’s interests in this proceeding, and not specifically as an instrument for negotiating a possible settlement agreement (in this regard, official communication DAA-OFI-585-2023 at image 77 of the interim-relief case file). Moreover, through the hearing granted, the respondent has had an opportunity to challenge the content of the official communication from both technical and legal perspectives, as will be analyzed in the following subsections in order to reach a decision on the State’s application and the respondent entity’s opposition. b) Regarding the prerequisites and requirements for the requested interim relief (medida cautelar).

Based on the foregoing, the Court proceeds to examine specifically the elements required by Articles 21 and 22 of the Contentious-Administrative Procedure Code with respect to the claims stated, in accordance with the arguments of both parties and the evidence submitted to the case file, noting that, pursuant to Article 220 of the aforementioned Code and Article 41 of the Civil Procedure Code, the interested party bears the procedural burden (carga procesal) of proving the assertions made in support of its claims. As to the first of these elements, corresponding to a prima facie case (apariencia de buen derecho), it must be emphasized that this issue must be analyzed in accordance with the parameters established in the Contentious-Administrative Procedure Code. In the case under review, a preliminary analysis of the application for interim relief shows that the theory of the case presented is reasonably substantiated.

Thus, without making a determination on the merits—which, in any event, is not appropriate in interim-relief proceedings—the petitioner is deemed entitled to challenge the alleged defects affecting the conduct at issue in the merits proceeding; moreover, because this is an interim measure sought during the proceeding (medida intraprocesal), such conduct has already passed the admissibility stage applicable to every action filed before this Court. The foregoing establishes that this element or prerequisite for interim relief has been met, based on allegations that must be examined in the corresponding merits proceeding, taking into consideration both Article 49 of the Constitution and the provisions of the Contentious-Administrative Procedure Code, which permit comprehensive review of the legality of administrative action and, in this case, of the respondent entity’s legal status and individual rights, the validity of which is challenged by the State.

This entails declaring the specific situations raised as the subject matter of this litigation legally noncompliant. As to the respondent’s objections, they do not in fact detract from the foregoing because, on the one hand, it acknowledges the general framework of the proceeding concerning the protection of the State’s natural heritage (patrimonio natural del Estado), particularly the public zone of the maritime-terrestrial zone (zona marítimo terrestre), and, on the other hand, its arguments regarding the unlawfulness of considering the study submitted by the Office of the Attorney General in support of the interim relief under review were rejected. The objections concerning the technical content and legal consequences of the submitted study do not undermine the conclusion, reached on the basis of a summary review (conocimiento sumario), that the petitioner’s theory of the case is neither reckless nor manifestly lacking in seriousness.

The prerequisite derived from Article 21 of the CPCA is therefore deemed satisfied. Nevertheless, as stated in the preceding recital (Considerando), for interim judicial protection (tutela cautelar) to be granted, the law requires that the implementation or continued existence of the administrative conduct submitted for review cause serious, actual, or potential harm or loss to the applicant’s legal position—in other words, that there be a risk arising from delay (peligro en la demora). In this regard, it must be emphasized that merely alleging the existence of serious harm or loss, whether actual or potential, is insufficient; it must be proven. This imposes a procedural burden on the interested party pursuant to Article 220 of the Contentious-Administrative Procedure Code and Article 41 of the Civil Procedure Code. Specifically with respect to this second element, this Court finds—taking into account consistent case law from both the Constitutional Chamber of the Supreme Court of Justice and the courts comprising the contentious-administrative jurisdiction—that environmental protection enjoys special protection.

By virtue of principles derived from Article 50 of the Constitution, including the preventive and precautionary principles (principio preventivo o precautorio), and in light of the documentation submitted, this special protection provides compelling support, from the standpoint of risk arising from delay, for granting the essential aspects of the interim-relief claims submitted by the State’s representatives. In this Court’s judgment, the content of Report SINAC-ACOPAC-CH-00034-2023 (images 5 through 46 of the interim-relief case file), together with other evidence, establishes a risk that serious damage will be caused to and consolidated within an ecosystem afforded special protection because of its vulnerability—an estuarine wetland (humedal de tipo estuario) of the mangrove class—as a result of the expansion of activities conducted on properties currently registered in the name of the respondent company.

The cited report contains, in its various sections, references to the delineation of its subject matter, the methodologies used, the theoretical framework related to the conceptualization of its wetlands, conservation and permitted activities, as well as a detailed account of findings conclusively establishing that the area studied—which, according to all the evidence considered, is also the subject of the dispute to be decided on the merits—contains a wetland ecosystem (ecosistema de humedad), as shown by the fauna found, hydrophilic vegetation (vegetación hidrófila), and hydrological conditions or regime (condición o régimen hídrico). It also refers to the application of a further series of scientific procedures, including retrospective and photointerpretive studies (estudios retrospectivos y fotointerpretativos) and determinations regarding the presence or absence of hydromorphic soils (suelos hidromórficos), all of which support its conclusions:

The properties bearing registration number 6-22964-000, survey plan 6-462593-1982, and registration number 6-44956-000, survey plan P-461951-1982, contain areas of an estuarine wetland ecosystem of the mangrove class. Some of these areas are currently used for agriculture and livestock farming and contain roads and drainage systems, causing serious harm to that ecosystem.

It is estimated that the area defined by survey plan 6-462593-1982 contains approximately 76 has 4671,59 m² of mangrove ecosystem.

It is also estimated that the property identified by survey plan P-461951-1982 contains an area corresponding to a mangrove ecosystem of approximately 22 has with 438m2.

The mangrove boundary line generated through this study is accurate with respect to the boundary between the mangrove ecosystem and other areas used for agriculture, and it must be used as the boundary reference when calculating the areas of new survey plans produced using surveying instruments.

The study concludes with recommendations, foremost among them the final recommendation, which establishes that, at this time, the possibility still exists that the sensitive areas considered to have been affected may be “restored and rehabilitated,” for which purpose the Sistema Nacional de Áreas de Conservación must undertake their recovery “through Ecological Restoration and Rehabilitation Plans for mangroves.” The document also includes references to bibliographic sources, evidence from soil studies, and photographs showing a cultivated wetland area, an area used for melon cultivation that was formerly mangrove, and another mangrove area used for crops. In the Court’s view, the document in question constitutes a technically and scientifically supported study and is also sufficient, within the context of the summary review conducted when analyzing whether interim relief (tutela cautelar) is warranted, to establish the risk inherent in delay (peligro en la demora) alleged by the State’s representative.

As noted, the study’s conclusions demonstrate that wetland areas have been affected or degraded by agricultural activities, but its recommendations also reveal the possibility of recovery and rehabilitation if appropriate plans are followed. It is therefore necessary to halt, as promptly as possible, the activities identified as causing degradation of and threats to the ecosystem present in the areas at issue in the litigation, which substantiates the risk inherent in delay that must be considered when ordering an interim measure (medida cautelar). The respondent contends that the conclusions of the cited study are disconnected from its content, that its technical basis is insufficient, and that it is inconsistent with the remaining evidence submitted by the State. As previously indicated, this Court does not agree with the respondent’s assertions concerning the study’s content in light of the limited review appropriate at this stage.

Nevertheless, it must not be forgotten that, within the proceedings on the merits (proceso de conocimiento), which are indispensable for reaching a final decision concerning their subject matter, the respondent will be able to present its arguments and the evidence supporting its objections in full. The Court also disagrees that the study is unrelated to other evidence submitted by the State, including reports DIG-TOT-INF-059-2020 and DRI-CTE-03-252-2018, which the respondent company itself offers in support of its objections. The first report presents findings consistent with the existence of mangrove areas within the land covered by plans P-461951-82 and P-462593-82 (see, in particular, the table appearing in image 203 of the main case file). The second, which concerns a cadastral reconciliation (conciliación catastral) of a property from which, among others, the respondent company’s properties would originate, and an analysis of possible overlaps between the land covered by the plans examined and the Zona Marítimo Terrestre, states, as relevant here: “With respect to the Zona Marítimo Terrestre, the overlay shows that plan P-461951-1982 (recorded under property 44956) is located partially within the area marked as Mangrove on the Herradura map sheet; in this area, there is no monument boundary line published by the Instituto Geográfico Nacional in the SNIT,” and “With respect to the MINAE boundary, the overlay shows that, of the plans related to property 44492, only plan P-461951-1982 is located within that MINAE area” (images 187 and 188 of the main case file).

Consequently, the aforementioned studies are consistent in all material respects with report SINAC-ACOPAC-CH-00034-2023, and nothing in their content, for purposes specific to this stage, is shown to diminish the weight of the latter study or, in particular, the basis for the risk inherent in delay that the Court finds in the application filed by the State. Finally, the respondent states that the evidence it submitted, appearing in images 63 to 65 of the interim-measure case file (translations in images 67 to 70), supports the existence of the risk inherent in delay because, it argues, those certificates demonstrate that the watermelon and melon crops grown on that land by Frutas Núñez LC del Pacífico S.A. satisfy rigorous standards of high ecological sustainability, based on the criteria and studies of a foreign entity specializing in such assessments. For this Court, the evidence submitted constitutes circumstantial evidence (elemento indiciario), but is insufficient to rebut the existence of a risk inherent in delay because, although the submitted certificate may be based on supporting technical and scientific studies, those studies were not attached; their contents are therefore unknown and cannot be assessed even summarily.

Moreover, the fact that cultivation conducted in certain areas is ecologically sustainable would not validate or cure the encroachment upon or impact on protected zones by such agricultural activity where those zones correspond to areas forming part of the State’s natural heritage (patrimonio natural del Estado). Having established the first two prerequisites, the third element, namely the balancing of the interests at stake (ponderación de los intereses en juego), must be analyzed. This Court considers that there is a correlation between the environment and human activity and that this final prerequisite must therefore be examined in detail in view of the interests involved. In this matter, and consistent with the foregoing discussion of the risk inherent in delay, the public interest embodied in the right to a healthy and ecologically balanced environment must prevail. This right concerns neither one person nor one group, but rather constitutes a general interest that must be weighed against the private interest of the company conducting the agricultural activities whose suspension is sought in the areas identified as being located within a zone protected because of its nature as a wetland (estuary type, mangrove class).

This is a specially protected category, as evidenced by the existence of international protective conventions to which the Costa Rican State is a signatory, and consideration must also be given to the fact that, under current conditions, these areas are said to be capable of regeneration and rehabilitation. Regarding the structural elements of the relief sought, this Court considers that all of them are present in the case under review. First, ancillary nature (instrumentalidad), the fundamental requirement of interim relief, must be considered: if the requested measure is not necessary to secure the subject matter of the proceedings and, fundamentally, the enforceability of a future judgment granting relief, the measure may not properly be granted. In this specific case, compliance with all prerequisites has been demonstrated, particularly the possibility of serious harm resulting from the delay in obtaining a ruling on the merits.

Accordingly, granting the relief requested on an interim basis is ancillary to ensuring the potential enforceability of a future judgment granting the State’s claims. As to provisional nature (provisionalidad), this Court likewise does not consider the relief sought to be inconsistent with this structural requirement, because if the requested measure were granted, it could be reversed in the event of a judgment adverse to the claimant, or even earlier by virtue of the revocability of granted measures provided for in section 29.1 of the CPCA. As to urgency (urgencia) and summary review (cognición sumaria), it would be redundant to address the former because it is closely linked to the risk inherent in delay, which, as explained, is deemed fully established in the case under review. As to the latter, as determined in the analysis of each prerequisite, it has been possible from that perspective to conduct a summary analysis of the likelihood of success on the merits (apariencia de buen derecho), the risk inherent in delay, and the balancing of the interests at stake, without encroaching upon or in any way reaching conclusions that would be premature because they properly belong in the judgment on the merits, after all procedural stages have been completed.

CONCLUSION: Because the statutory prerequisites have been satisfied and the structural requirements of the relief sought are present, the requested interim measure is hereby granted on a final basis until this Court orders otherwise, under the terms set forth below. Consequently: (i) the respondent company is ordered immediately to suspend all unauthorized productive, agricultural, livestock-raising, or other activities within the area delineated as mangrove in report SINAC-ACOPAC-CH-00034-2023, conclusions one, two, and three; and (ii) subject to prior coordination, the respondent company shall permit officials of the Sistema Nacional de Áreas de Conservación to enter the specified areas so that they may verify compliance with the preceding provision, assess matters relating to the exercise of their powers, and schedule actions for the restoration and recovery of the mangrove areas. In the event of an unjustified refusal to comply with this provision, the appropriate application shall be filed with the enforcement division (área de ejecución) of this Court. c) Regarding the request for countersecurity (contracautela).

In essence, the respondent seeks to require the State to provide security for possible damages resulting from the enforcement of the requested interim measure; however, it neither quantifies nor reliably substantiates its request. This Court finds that, because the State cannot declare itself insolvent and because of the constitutionally and statutorily established system of administrative liability, the requested countersecurity is improper. If the State’s conduct is ultimately considered to cause compensable harm, the respondent may pursue the appropriate proceeding to assert State liability and seek the corresponding compensation. d) Regarding costs. No special award of costs is made.

POR TANTO

FIRST: The interim measure requested by the State’s representative is hereby granted on a final basis until this Court orders otherwise, under the following terms: (i) the respondent company is ordered immediately to suspend all unauthorized productive, agricultural, livestock-raising, or other activities within the area delineated as mangrove in report SINAC-ACOPAC-CH-00034-2023, conclusions one, two, and three; and (ii) subject to prior coordination, the respondent company shall permit officials of the Sistema Nacional de Áreas de Conservación to enter the specified areas so that they may verify compliance with the preceding provision, assess matters relating to the exercise of their powers, and schedule actions for the restoration and recovery of the mangrove areas. In the event of an unjustified refusal to comply with this provision, the appropriate application shall be filed with the enforcement division of this Court. N° 2024005331 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las uno horas con treinta y seis minutos del veinte de Agosto del dos mil venticuatro.- Se conoce solicitud de MEDIDA CAUTELAR interpuesta la representacion estatal, dentro del proceso de conocimiento establecido por el ESTADO, representado por la procuradora Natalia Aguilar Porras, carné número 17419, contra UNIÓN DISTRIBUIDORA FERAROSSE S.A., cédula de persona jurídica 3-101-231155, representada por su apoderado especial judicial, Andrés A. Pérez González, carné número 4263.-

RESULTANDO

1- Mediante escrito fechado 23 de diciembre de 2023 la representación estatal interpone solicitud de medida cautelar (ver memorial en imágenes 2 a 4 del expediente judicial electrónico legajo de medida cautelar versión PDF orden descendente, en adelante "expediente de medida cautelar").- 2- En resolución de las ocho horas veintitrés minutos del quince de febrero de dos mil veinticuatro, se otorga audiencia de gestión cautelar a la sociedad demandada.- 3- En memorial fechado 23 de febrero de 2024, la representación de UNIÓN DISTRIBUIDORA FERAROSSE S.A. se opone a la solicitud de tutela que se analiza (ver imágenes 53 a 62 del expediente de medida cautelar).- 4- Con resolución de las catorce horas cuarenta y seis minutos del veintiséis de junio de dos mil veinticuatro, se concede audiencia a la representación estatal sobre la contraprueba y solicitud de contracautela peticionada por la sociedad accionada.- 5- La representación estatal presenta su réplica mediante escrito fechado 2 de julio de 2024 (ver imágenes 74 a 76 del expediente cautelar).- 6- En los procedimientos se han observado las prescripciones de rigor y no se notan causales de nulidad capaces de invalidar lo actuado.-

CONSIDERANDO

I. OBJETO DE LA MEDIDA CAUTELAR

La parte actora promueve medida cautelar a efectos de que: "...se ordene la suspensión inmediata de toda actividad productiva, agrícola, ganadera o de cualquier otra índole dentro del área delimitada como manglar en el informe SINAC-ACOPAC-CH-00034-2023 y que se permita el libre acceso de los funcionarios del Sistema Nacional de Áreas de Conservación a dichas áreas a fin deque puedan verificar el acatamiento a dicha disposición".

III. ARGUMENTOS DEL PROMOVENTE

La representación estatal expone que la apariencia de buen derecho necesaria para la adopción de lo peticionada está dada porque el demanio litoral lo incorporan los manglares (Corte de Casación sentencia de 13:17 hrs. de 24 de febrero de 1911, considerando 3; Sala de Casación, voto 121 de 16 horas del 14 de noviembre de 1979), los cuales, en la actualidad, constituyen humedales e integran el Patrimonio Natural del Estado y conservan ese carácter aun cuando hayan sido desprovistos de su vegetación o condiciones originarias (artículos 262 del Código Civil y 2 de la Ley de Aguas; numerales 13, 14, 15 de la Ley Forestal; 32 y 38 de la Ley 7554; Decretos 7210, 16852, 22550 y 23247). Se afirma que en este asunto, ciertos manglares además forman parte del Refugio Nacional de Vida Silvestre Playa Hermosa-Punta Mala (cita el informe No. DRI-CTE-03-252-2018 del 29 de noviembre del 2018 imagen 14 como prueba de la demanda, y Decreto No. 27210, artículo 1.d).

Se añade que al incluir a los manglares dentro del concepto de zona pública de la zona marítimo terrestre, y no el de zona restringida, el legislador ha querido reforzar este recurso natural otorgándole su máxima protección, liberándolo de probables presiones por su tenencia y reduciendo los riesgos de deterioro o destrucción, por lo que debe ponderarse el interés público del Estado de garantizar, defender y preservar el derecho al medio ambiente sano y ecológicamente equilibrado (Art 50 Constitución Política y 1 de la Ley Orgánica del Ambiente) y que la tutela planteada se solicita con la finalidad de proteger y garantizar, provisionalmente, el objeto del proceso y la efectividad de la sentencia. La representación estatal estima que en el caso particular del tipo de bienes aquí involucrados, grave perjuicio sería el demorar la protección y recuperación de un ecosistema de alta fragilidad ambiental como lo es el manglar y que la adopción de estas medidas debe analizarse a través de la óptica del principio preventivo propio del Derecho Ambiental, en virtud del cual: “La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos.

Consecuentemente, el principio rector de prevención se fundamente en la necesidad de tomar y asumir todas las medidas precautorias para contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible –o una duda al respecto- se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados en el ambiente” (Sala Constitucional. Resolución No. 1250-99 de las 11 horas 24 minutos del 19 de febrero de 1999). Para concluir se expone que en el informe SINAC-ACOPAC-CH-00034-2023 se evidenció que dentro de la delimitación marcada como de manglar existen algunas áreas utilizadas para la agricultura y ganadería por lo que, habiendo fracasado la conciliación, prevalece una seria preocupación a los intereses de mi representado por la afectación que esto pueda causar a ese ecosistema de humedal costero en el caso de posponerse hasta la finalización del proceso la adopción de las medidas necesarias para su protección.

En sus manifestaciones posteriores, la representación estatal objeta las presuntas debilidades de su base probatoria y la confidencialidad alegada por la parte accionada en relación con el informe SINAC-ACOPAC-CH-00034-2023, y también se opone al establecimiento de una contracautela de acogerse la tutela pedida. Estima la representación del Estado que la petición confirma la preocupación del órgano procurador al interponer esta medida cautelar, ya que se estaría evidenciando que desde el momento que la contraparte tuvo conocimiento del informe rendido No. SINAC-ACOPAC-CH-00034-2023, que delimita concretamente el área de manglar dentro de la finca, se ha continuado con la producción agrícola en esas áreas, a pesar contar con la información técnica de su verdadera naturaleza y de la afectación que se estaría causando al ecosistema de manglar, y concluye que la contracautela debe rechazarse por improcedente, indeterminada, improbada e ilógica.

III. ARGUMENTOS DE LA DEMANDADA

La sociedad demandada expone de previo su oposición al informe SINAC-ACOPAC-CH-00034-2023 de 19 de junio de 2023, aportado por la representación estatal, al respecto considera que el citado informe y los estudios complementarios fueron elaborados a propósito del acercamiento entre las partes y dentro del proceso de un conciliación que, por la naturaleza del objeto del conflicto, se ha extendido por varios meses e incluso años, y que por ese motivo, con fundamento en la Ley de Resolución Alterna de Conflictos y Promoción de la Paz Social, artículo 14, ese estudio tiene un carácter absolutamente confidencial, por estar vinculado al contenido de las actividades preparatorias, conversaciones y convenios parciales del acuerdo conciliatorio. Se añade que el precitado informe es la base de la tutela solicitada y c onsecuencia de lo que viene expuesto es que el único elemento probatorio que ofrece la Procuraduría General de la República, no puede ser utilizado legalmente en el proceso, pues de admitirse para sustentar en él cualquier decisión judicial, se estaría quebrantando la absoluta confidencialidad que priva por disposición legal en el ámbito de las conciliaciones.

En relación con la fundamentación de la medida planteada se objetan los hechos expuestos y se niega la concurrencia de los presupuestos para su otorgamiento. En cuanto a la apariencia de buen derecho, se manifiesta que en la extensa exposición realizada por la Procuraduría General de la República en el memorial de solicitud de la medida cautelar, se realiza una descripción de los fundamentos constitucionales, legales y jurisprudenciales de la tutela de la zona marítimo terrestre y del manglar, pero que sobre este tema no existe discusión, y que donde radica el punto álgido del problema es en el ofrecimiento del elemento probatorio que sustenta las proposiciones fácticas que dan sustento a la solicitud de tutela cautelar y que como se ha indicado corresponde a un informe que las partes acordaron tener para procurar resolver el conflicto dentro del contexto de la conciliación que se llevaba a cabo entre las partes y que es por esa conciliación y no con fundamento en otra razón, que se solicitó que el Programa de Humedales del Área de Conservación Pacífico Central del SINAC determinara el alcance del manglar dentro de los inmuebles objeto del proceso (6-22964-000 y 6-44956-000).

Se afirma que los elementos de prueba a que se ha hecho referencia al dar contestación a la presente medida cautelar, ciertamente, no acreditan que dentro de la delimitación del manglar existan áreas utilizadas para la agricultura y menos aún a la ganadería que puedan afectar el ecosistema del humedal costero, y que la única alusión a esa circunstancia se referencia en el acápite de conclusiones del documento elaborado por el señor Julio César Solano Durán a propósito de la conciliación que las partes buscaban concretar. Se enfatiza, en demérito del estudio que invoca el Estado y objeta la accionada, que cuando se emite opinión experta es insuficiente emitir conclusiones del tipo que contiene el citado documento y se requiere adicionalmente que las conclusiones sean vertidas sobre bases sólidas desde el punto de vista teórico y conforme a una rigurosa investigación científica intersubjetivamente controlable.

En este caso, la conclusión acerca de la posible afectación al manglar, se desconoce si está fundada en la observación, en la experiencia o en técnicas científicas validadas por la comunidad experta, sea conforme a los métodos usuales de la ciencia, de lo contrario no se conoce su fiabilidad y su precisión (NAS REPORT 2009, p. 128). Niega también la accionada la existencia de peligro en la demora, y esgrime que ausente se encuentra además la argumentación y más allá de ello, la demostración del peligro que pueda sufrir el ecosistema del manglar o de la zona marítimo terrestre por el uso agrícola que se realiza en la finca es inevitable indicar, para ilustrar a la persona juzgadora, que se trata de una finca en que se realiza una explotación conforme a normas internacionales de control de uso de productos agroquímicos, pues toda la cosecha es de exportación y debe responder con estricto control al cumplimiento de normas internacionales en defensa del medio ambiente y de la salud humana.

Se añade que el reporte realizado se refiere a actividad agrícola sin precisar qué tipo de actividad, pues existen sustanciales diferencias entre la explotación de la tierra para el cultivo del arroz (actividad productiva que no se realiza en las fincas) o en la explotación del melón o la sandía (que son actividades que sí se realizan en la finca y que no afectan el manglar ni la zona marítimo terrestre),por cuanto la finca se explota bajo el esquema Global G.A. P. que está previsto para que la producción agrícola se desarrolle de manera segura y sostenible con el fin de beneficiar no sólo a los productores sino a los consumidores y remite para consulta al sitio www.globalstd.com y que la empresa Frutas Nuñez L C del Pacífico S. A., a cargo de la producción, cuenta con la certificación que expide precisamente la empresa Global G.A. P por lo que el manejo de la finca es absolutamente seguro y amigable con el medio ambiente.

Como prueba en fundamento de su oposición la parte accionada ofrece INFORME DIG-TOT-INF-059-2020 preparado por el Geógrafo Giovanni Oconitrillo Chaves, Analista Subproceso Clasificación Territorial, del Departamento Topográfico y Observación del Territorio Instituto Geográfico Nacional - Registro Nacional, el 9 cual fue ofrecido como prueba por la Procuraduría General de la República al momento de interponer la demanda y se encuentra agregado al expediente principal.

imágenes 195 a 203 del expediente judicial carpeta principal Informe DRI-CTE-03-252-2018 del 29 de noviembre del 2018 en el que se solicita una conciliación catastral de la finca 106093 y sus segregaciones, así como evidenciar posibles afectaciones a la Zona Marítimo Terrestre o Manglar, el Ing. Roberto Segura González.

imágenes 173 a 194 del expediente judicial carpeta principal Certificado emitido por Global G.A. a la empresa Frutas Nuñez LC del Pacífico S A. y su correspondiente traducción, con lo que se demuestra los estándares aplicados en la explotación de la finca imágenes 63 a 65 del expediente de medida cautelar y traducciones en imágenes 67 a 70.

Para finalizar, la parte accionada pide que si se otorga lo pedido por el Estado se imponga una cautela que permita garantizar los daños y perjuicios que se puedan irrogar derivadas de las limitaciones impuestas de manera absolutamente injustificada sobre un área tan considerable de la finca, que por lo demás es explotada comercialmente en siembra y comercialización de sandía y meló, por lo que considera que el Estado ha de garantizar con una suma razonable y según la extensión del terreno, conforme lo determine la autoridad judicial.

IV.EN GENERAL SOBRE LOS PRESUPUESTOS NECESARIOS PARA EL OTORGAMIENTO DE UNA MEDIDA CAUTELAR Y SUS CARACTERÍSTICAS ESTRUCTURALES INDISPENSABLES. La jurisprudencia ha desarrollado ampliamente el objeto de la justicia cautelar, la cual responde a la necesidad de garantizar el principio constitucional de una justicia pronta y cumplida, al conservar las condiciones reales indispensables para la emisión y ejecución de la sentencia. En este mismo sentido, el artículo 19 del Código Procesal Contencioso Administrativo, establece que el fin de la fijación de una medida cautelar es proteger y garantizar, provisionalmente el objeto del proceso y la efectividad de la sentencia. Partiendo de lo anterior, la persona juzgadora con observancia de lo dispuesto en el artículo 21 de la norma procesal indicada, debe determinar la procedencia de una solicitud de medida cautelar, verificando al efecto que la pretensión del proceso de conocimiento no sea temeraria o en forma palmaria, carente de seriedad, lo que constituye una valoración preliminar del fondo para determinar si existe en el caso en cuestión lo que la doctrina y la jurisprudencia han llamado apariencia de buen derecho o fumus boni iuris.

La norma de análisis también establece la procedencia de la medida cautelar cuando la ejecución o permanencia de la conducta sometida a proceso produzca graves daños o perjuicios, actuales o potenciales, situación que ha sido conceptualizada como peligro en la demora, por ende, que en razón de la demora del proceso judicial, se haga ineludible un peligro actual, real y objetivo de que generaría a la parte promovente un daño grave. Bajo la misma línea de pensamiento, el artículo 22 del Código Procesal Contencioso Administrativo, establece la obligación de la persona juzgadora de realizar a la luz del principio de proporcionalidad, una ponderación de los intereses en juego entre la circunstancia del particular, por un lado y por el otro, el interés público, así como los intereses de terceros que puedan verse afectados con la adopción de la medida cautelar. Para la determinación de la procedencia de la medida es también importante tomar en cuenta, que la medida que vaya adoptarse estructuralmente cuente con las siguientes características: 1.-) La instrumentalidad e independencia previa con relación a la sentencia definitiva que se produzca en un proceso principal, cuestión que determina al propio tiempo, la subordinación o accesoriedad de la medida con respecto del proceso principal dentro, o a efecto del cual se dicta. 2.-) La provisionalidad, en cuanto su eficacia en principio se agota al momento de dictarse la sentencia de mérito en el asunto principal o cuando las circunstancias así lo impongan.

Es decir, tiene efectos supeditados a la pendencia de aquel proceso, tanto como y, -por otro lado-, a la permanencia en el tiempo de la circunstancias que fuesen tomadas en cuenta para su adopción, características que traen causa de su intrínseca posibilidad de modificación o revocación (eficacia rebus sic stantibus). 3.-) La urgencia para evitar el peligro en la mora, nota que justifica las medidas cautelares adoptadas ante causam, prima facie o inaudita altera parte. 4.-) La sumaria cognitio, esto es, que este tipo de medidas son adoptadas en virtud de una cognición sumarísima efectuada por el órgano jurisdiccional, sin entrar a prejuzgar sobre el mérito del asunto, que de forma alguna sustituye la plenaria sucesión de pasos que implica el proceso de conocimiento.-

V. SOBRE EL CASO CONCRETO

  • a)Sobre la admisibilidad del Informe SINAC-ACOPAC-CH-00034-2023. Analizado el formato del referido documento, su formato y sus anexos, este tribunal concluye que no está afectado por la confidencialidad que aduce la parte accionante. La finalidad de la normativa que contiene la Ley de Resolución Alterna de Conflictos y Promoción de la Paz Social sobre confidencialidad , y particularmente su artículo 14, no son aplicables a este caso y al oficio cuya consideración se impugna. En primer lugar su contenido no comprende "actividades preparatorias, conversaciones y convenios parciales del acuerdo conciliatorio", por el contrario se trata de un informe técnico en el cual se exponen aspectos considerados y conclusiones, no alude en modo alguno a las propuestas de las partes, concesiones recíprocas en relación con el objeto del proceso sometido a posible conciliación, tampoco evidencia del contenido de negociaciones preliminares ni de acuerdos parciales, que en este caso no existieron.

El sentido de la normativa invocada es evitar que las manifestaciones que se dan en el contexto de un arreglo o posible arreglo no perjudiquen o se usen posteriormente a quien las emite, el documento no contiene informaciones o referencias de ese tipo, por lo cual carece del sustento jurídico indicado la objeción de la parte actora a su admisibilidad como medio probatorio a ser valorado. En segundo lugar, la redacción y estructura del documento son concordantes con la afirmación del órgano procurador de que se elaboró para su utilización en defensa de los intereses del Estado en este proceso, no específicamente como instrumento para la negociación de un posible acuerdo conciliatorio (en tal sentido oficio DAA-OFI-585-2023 en imagen 77 del expediente de medida cautelar). Por otra parte, a partir de la audiencia conferida la parte accionada ha tenido la oportunidad de objetar, desde las perspectivas técnica y jurídica, el contenido del oficio, como se analizará en los siguientes acápites a fin de llegar a una decisión sobre la solicitud del Estado y la oposición de la entidad accionada. b) Sobre los presupuestos y requisitos de la medida peticionada.

Partiendo de lo anteriormente expuesto, se procede a realizar el estudio concreto de los elementos requeridos por los artículos 21 y 22 del Código Procesal Contencioso Administrativo, en cuanto a las pretensiones indicadas, de acuerdo con los argumentos de ambas partes y los elementos de prueba aportados al expediente, haciendo la observación que es una carga procesal para la parte interesada, al tenor de los artículos 220 del mencionado Código y el 41 del Código Procesal Civil, probar las afirmaciones que haga en apoyo de sus pretensiones. En cuanto al primero de ellos, correspondiente a la apariencia de buen derecho, se debe recalcar que este punto debe ser analizado de conformidad con los parámetros dispuestos en el Código Procesal Contencioso Administrativo, en el caso que se analiza del análisis de la solicitud cautelar, se observa, de forma preliminar, que la teoría del caso expuesta está razonablemente motivada, de manera que, sin entrar en un juicio de valor sobre el fondo (lo cual, en todo caso, no es propio del proceso cautelar), se estima que la parte accionante se encuentra facultada para impugnar los supuestos vicios que afectan las conductas que son objeto del proceso de conocimiento, que por otra parte y tratándose de una medida intraprocesal ya han superado el trámite de admisibilidad de toda demanda planteada en esta sede.

Lo indicado permite determinar la procedencia de este elemento o presupuesto de la medida cautelar en virtud de alegatos que deberán ser analizados en el proceso de fondo correspondiente, en consideración tanto de lo establecido en el artículo 49 Constitucional como de lo que se estipula en el Código Procesal Contencioso Administrativo, que posibilita ejercer un control plenario de la legalidad de la función administrativa, y en este caso, de la situación jurídica y derechos subjetivos de la entidad accionada cuya validez impugna el Estado, lo cual implica declarar la disconformidad jurídica de las situaciones concretas planteadas como objeto de este litigio. En cuanto a las objeciones de la parte accionada, en realidad no demeritan lo indicado, toda vez que, por una parte, admite el marco general del proceso relativo a la protección del patrimonio natural del Estado y particularmente la zona pública de la zona marítima terrestre, y por otra, se desecharon sus argumentaciones sobre la ilegalidad de tomar en cuenta el estudio presentado por el órgano procurador en sustento de las medidas cautelares que se analizan.

Las objeciones referentes al contenido técnico y consecuencias jurídicas del estudio aportado no demeritan que a nivel de un análisis o conocimiento sumario se llegue a la conclusión que la teoría del caso de la parte actora no es temeraria ni palmariamente carente de seriedad, con lo cual se tiene por cumplido el presupuesto analizado que se deriva del numeral 21 del CPCA. Ahora bien, como se indicó en el Considerando anterior, para la procedencia de la tutela cautelar se requiere según disposición legal, que la ejecución o permanencia de la conducta administrativa sometida al proceso produzca daños o perjuicios graves, actuales o potenciales, en la situación jurídica del promovente, en otras palabras existencia de peligro en la demora. En ese sentido, debe recalcarse que no basta con alegar la existencia del daño (o perjuicio) grave (actual o potencial), sino que debe probarse, situación que implica una carga procesal que debe asumir la parte interesada, al tenor de los artículos 220 del Código Procesal Contencioso Administrativo y el 41 del Código Procesal Civil.

Específicamente en relación con este segundo elemento analizado, es criterio de este despacho, tomando en consideración reiterada jurisprudencia, tanto de la Sala Constitucional Constitucional de la Corte Suprema de Justicia como de los Despachos que integran la jurisdicción contencioso administrativa, que la tutela del ambiente goza de una especial protección, que en virtud de principios derivados del numeral 50 constitucional implica principios tales como el principio preventivo o precautorio, que en virtud de la documentación aportada sustenta, desde la perspectiva del peligro en la demora y de manera contundente, el otorgamiento en lo fundamental de las pretensiones cautelares planteadas por la representación estatal. En criterio de este Tribunal, el contenido del informe SINAC-ACOPAC-CH-00034-2023 (imágenes 5 a 46 del expediente de medida cautelar) junto con otros elementos sustentan un peligro de perpetración y consolidación de daños graves a un ecosistema especialmente protegido en razón de su vulnerabilidad (humedal de tipo estuario de clase manglar) por la extensión de actividades que se llevan a cabo en inmueble inscritos actualmente a nombre de la sociedad accionada.

Según el citado informe que contiene en sus diversos acápites referencias a la delimitación de su objeto, metodologías empleadas, marco teórico relacionado con la conceptualización de sus humedales, conservación y actividades permitidas, así como puntualización de los hallazgos concluyentes de la existencia en el área estudiada (y según todos los indicios considerados también objeto del litigio por definir en cuanto al fondo) de un ecosistema de humedad (fauna encontrada, vegetación hidrófila, condición o régimen hídrico), así como referencia a la aplicación de otra serie de procedimientos científicos (estudios retrospectivos y fotointerpretativos, determinación de presencia o ausencia de suelos hidromórficos), todo lo cual sustenta sus conclusiones:

Las fincas con matrícula 6-22964-000, plano 6-462593-1982 y matrícula 6-44956-000, plano P-461951-1982, poseen áreas de ecosistema de Humedal de tipo Estuarino clase Manglar. Actualmente algunas de estas áreas se encuentran utilizadas para la agricultura y ganadería, con caminos y drenajes, causando grave afectación a dicho ecosistema.

Se estima que en el área definida por el plano 6-462593-1982 existe un área de 76 has 4671,59 m² aproximadamente de ecosistema de manglar.

También se estima que para la finca con plano P-461951-1982 existe un área que corresponde a ecosistema de manglar de aproximadamente 22 has con 438m2.

La línea de manglar generada mediante el presente estudio es precisa respecto al límite del ecosistema de manglar con otras áreas dedicadas a agricultura; y se debe utilizar como referencia de límite para calcular las áreas de los nuevos planos que se generen con instrumentos topográficos.

El estudio concluye con recomendaciones, dentro de las que destaca la final, que establece en este momento todavía existe la posibilidad de que las áreas sensible que se consideran afectadas puedan ser "restauradas y rehabilitadas" para lo cual el Sistema Nacional de Áreas de conservación deberá realizar una recuperación "por medio de Planes de Restauración y Rehabilitación ecológica para manglares". El documento incluye también referencia a fuentes bibliográficas, evidencia de estudios de suelo y fotografías que muestran área de humedal labrada, área de cultivo de melón que en el pasado fue manglar y otra área de manglar utilizada para cultivos. En criterio del tribunal, el referido documento corresponde a un estudio sustentado técnica y científicamente, y también resulta suficiente en el contexto del conocimiento sumario que se lleva a cabo en el análisis de la procedencia de una tutela cautelar para tener por acreditado el peligro en la demora que alega la representación estatal.

Como se destacó, las conclusiones del estudio evidencian la afectación de áreas de un humedal y su afectación o degradación por actividades agrarias, pero el contenido de sus recomendaciones devela también la posibilidad de recuperación y rehabilitación si se siguen planes adecuados, por lo cual es necesario que se detengan con la mayor celeridad posible las actividades que se señalan como causantes de la degradación y amenazas al ecosistema presente en las áreas a las cuales se refiere el litigio, lo cual sustenta el peligro en la demora que debe contemplarse a la hora de decretar una medida cautelar. La parte accionada sostiene que las conclusiones del referido se desvinculan del contenido y que su base técnica es insuficiente, asimismo que no concuerda con la restante prueba aportada por el Estado. Como se señaló previamente, este despacho no coincide con las afirmaciones de la accionada sobre el contenido del estudio a la luz del conocimiento propio de esta fase, pero tampoco se debe olvidar que en el marco del proceso conocimiento, indispensable para llegar a una decisión final sobre el objeto del proceso de conocimiento, la parte podrá demandada podrá exponer ampliamente sus argumentos y la prueba de sustento de sus objeciones.

También se disiente en cuanto a que el estudio no guarde relación otras probanzas aportadas por el Estado, dentro de ellas los informes DIG-TOT-INF-059-2020 y DRI-CTE-03-252-2018 que la propia sociedad accionada ofrece en respaldo de sus objeciones. En el primero de ellos se exponen resultados que son concordantes con la existencia de áreas de manglar comprendidas en los terrenos que abarcan los planos P-461951-82 y P-462593-82 (ver en particular cuadro ubicado en imagen 203 del expediente principal). En el segundo, que corresponde a una conciliación catastral de una finca que originaría, entre otras, las propiedades de la sociedad accionada, y análisis de posibles traslapes entre los terrenos comprendidos en los plantos analizados y la Zona Marítimo Terrestre, y en lo que interesa señala: "Con respecto a la Zona Marítimo Terrestre, del montaje se logra apreciar que el plano P-461951-1982 (publicitado en la finca 44956) se encuentra ubicado en parte dentro del área demarcada en la hoja cartográfica Herradura como Manglar, en esta zona no se cuenta con línea de mojones publicitada por el Instituto Geográfico Nacional en el SNIT" y "Con respecto a la demarcación del MINAE, se logra apreciar en el montaje que de los planos relacionados a la finca 44492 que únicamente el plano P-461951-1982 se ubica entro de dicha zona del MINAE" (imágenes 187 y 188 del expediente principal).

Por consiguiente, los precitados estudios concuerdan en lo fundamental con el informe SINAC-ACOPAC-CH-00034-2023, y no se evidencia que en forma alguna su contenido, para lo efectos propios de esta etapa, demerite el contenido del último estudio citado y, en particular, el sustento del peligro en la demora que el tribunal aprecia en la solcitud planteada por el Estado. Para finalizar, la parte accionada manifiesta que la prueba por ella aportada, visible en imágenes 63 a 65 del expediente de medida cautelar (traducciones en imágenes 67 a 70) respaldan la existencia del peligro en la demora, porque según argumenta, esos certificados demuestran que los cultivos de sandía y melón que en esos terrenos lleva a cabo Frutas Núñez LC del Pacífico S.A., cumplen criterios rigurosos de alta sostenibilidad ecológica, al amparo de criterios y estudios de una entidad extranjera especializada en tales valoraciones.

Para este tribunal la prueba aportada constituye un elemento indiciario, pero insuficiente para desvirtuar la existencia de peligro en la demora, por cuanto, no si bien el certificado aportado puede respaldarse en estudios técnicos y científicos que lo respaldan, estos no se adjuntan, por lo cual son desconocidos y no se pueden evaluar ni siquiera someramente. Por otra parte, que el cultivo que se desarrolle en áreas sea sustentable ecológicamente no covalidaría o subsanaría que esa actividad agraria invada o afecte zonas protegidas y que correspondan a áreas que forman parte del patrimonio natural del Estado. Teniendo acreditados los dos primeros presupuestos, debe analizarse el tercer elemento, correspondiente a la ponderación de los intereses en juego. Considera este tribunal que existe una correlación del medio ambiente y la acción del hombre, por lo que, debe examinarse con detalle este último presupuesto por los intereses que intervienen.

Del presente asunto y en línea con lo expuesto en cuanto al peligro en la demora, debe prevalecer el interés público materializado en el derecho al ambiente sano y ecológicamente equilibrado, el cual no incumbe a una persona o a un grupo sino que es un interés general frente al interés particular de la empresa desarrolladora de las actividades agrarias que se pide suspender en las áreas que se ha señalado tienen lugar en una zona protegida por su naturaleza de humedal (tipo estuario, clase manglar), categoría especialmente protegida, como se evidencia por la existencia de convenios internacionales de protección de los cuales el Estado costarricense es signatario, y atendiendo también a que en la situación actual se trata de áreas que según se afirma son susceptibles de regeneración y rehabilitación. En lo relativo a los elementos estructurales de la tutela peticionada, este Tribunal considera que todos convergen en el caso analizado.

En primer lugar se debe considerar la instrumentalidad, que es el requisito fundamental de la tutela cautelar: si la medida peticionada no es necesaria para asegurar el objeto del proceso y, fundamentalmente, la ejecutabilidad de una futura sentencia estimatoria, su otorgamiento es improcedente. En el caso concreto, han sido demostrado el cumplimiento de la totalidad de los presupuestos, en particular la posibilidad de daños graves por la demora en obtener un pronunciamiento sobre el fondo del asunto, de modo que el otorgamiento de lo peticionado cautelarmente resulta instrumental para garantizar una eventual la ejecutabilidad de una eventual sentencia estimatoria de las pretensiones del Estado. En cuanto a la provisionalidad, tampoco considera este Despacho que lo peticionado no se ajuste a este requisito estructural, toda vez que otorgada la medida solicitada, podría retrotraerse en caso de una sentencia negativa para la parte actora, e incluso antes por efecto de la revocabilidad de las medidas que se otorguen, contemplada en el numeral 29.1 del CPCA.

En cuanto a la urgencia y la cognición sumaria, sobre el primero sería redundante referirse, habida cuenta que está fuertemente ligado al presupuesto del peligro en la demora, que como ha sido expuesto, se considera plenamente acreditado en el caso que se analiza, y en cuanto al segundo, como se ha estimado en el análisis de cada uno de los presupuestos, el análisis sumario de la la apariencia de buen derecho, el peligro en la demora y la ponderación de intereses en juego ha sido posible desde tal perspectiva, sin necesidad de invadir o en forma alguna llegar a conclusiones que resultan prematuras por ser propia de la sentencia que se dicte sobre el fondo, previo agotamiento de todas las etapas del procedimiento. CONCLUSIÓN: Por cumplirse los presupuestos legales y converger los requisitos estructurales de la tutela peticionada, se acoge con carácter definitivo hasta que este tribunal no disponga lo contrario la medida cautelar solicitada, en los términos que se indicarán, en consecuencia: (i) se ordena a la sociedad accionada la suspensión inmediata de toda actividad productiva, agrícola, ganadera o de cualquier otra índole no autorizada dentro del área delimitada como manglar en el informe SINAC-ACOPAC-CH-00034-2023, conclusiones primera, segunda y tercera; y (ii) la sociedad accionada deberá, previa coordinación, permitir el ingreso de los funcionarios del Sistema Nacional de Áreas de Conservación a las áreas indicadas para que puedan verificar el acatamiento de lo dispuesto en el punto precedente y evaluar lo referente al ejercicio de sus competencias y programar las acciones para la restauración y recuperación de las áreas de manglar, en caso de renuencia injustificada a cumplir con lo señalado en este punto, se deberá plantear lo que corresponda ante el área de ejecución de este Tribunal. c) Sobre la solicitud de contracautela.

Básicamente la parte accionada pretende que el Estado rinda caución por posibles daños derivados de la ejecución de la medida cautelar peticionada, no obstante, no cuantifica ni justifica fehacientemente su pretensión. Este tribunal estima que en razón de la imposibilidad del Estado de declararse en insolvencia, así como debido al régimen de responsabilidad administrativa que constitucional y legalmente se encuentra establecido, la contracautela peticionada es improcedente, y si se llegase a considerar que la conducta del Estado genera daños que deban ser reparados, la parte accionada podrá acudir a la vía correspondiente para exigir la responsabilidad estatal y las indemnizaciones correspondientes. d) Sobre las costas. Se resuelve sin especial condena en costas.

POR TANTO

PRIMERO: Se acoge con carácter definitivo hasta que este tribunal no disponga lo contrario, la medida cautelar solicitada por la representación estatal, en los siguientes términos: (i) se ordena a la sociedad accionada la suspensión inmediata de toda actividad productiva, agrícola, ganadera o de cualquier otra índole no autorizada dentro del área delimitada como manglar en el informe SINAC-ACOPAC-CH-00034-2023, conclusiones primera, segunda y tercera; y (ii) la sociedad accionada deberá, previa coordinación, permitir el ingreso de los funcionarios del Sistema Nacional de Áreas de Conservación a las áreas indicadas para que puedan verificar el acatamiento de lo dispuesto en el punto precedente y evaluar lo referente al ejercicio de sus competencias y programar las acciones para la restauración y recuperación de las áreas de manglar, en caso de renuencia injustificada a cumplir con lo señalado en este punto, se deberá plantear lo que corresponda ante el área de ejecución de este Tribunal. SEGUNDO: Se rechaza la solicitud de contracautela peticionada por la sociedad accionada. TERCERO: Se resuelve sin especial condena en costas. (f) José Roberto Brenes Chinchilla. JUEZ.
