CONSIDERING

I. MOTIONS FOR PROMPT DISPOSITION (GESTIONES DE PRONTO DESPACHO)

The proponent of this precautionary measure has filed multiple motions for prompt disposition and alleges “…that the precautionary measure was filed on 4 de agosto de 2023 and, to date, this judicial authority has issued no decision”; however, he overlooks the fact that he himself has contributed to this matter not having been decided sooner, as he has filed multiple expansions and has submitted evidence to assist adjudication on several occasions, a circumstance that has caused some confusion in the case file. To safeguard due process (debido proceso) and the right of defense (derecho de defensa), each filing has been served upon the parties involved for a hearing; indeed, the decision issued at thirteen hours and forty-seven minutes on veinticinco de setiembre de dos mil veintitrés clarified: “…once all parties have been served with this application for precautionary relief and the period for responding has expired, the case file will be submitted for decision so that it may be resolved according to its place in the assigned order.

The parties are advised that matters are decided according to their position in the queue of cases submitted for decision, that is, from the earliest matter entered in that queue to the most recently entered matter, following the principle that the first in time is the first in right.” Accordingly, this application for precautionary relief is resolved in its proper turn, additionally considering that the proponent does not meet the user-vulnerability criteria for priority attention, although this Tribunal does not disregard the importance of the environmental issue, and the Court does not have Judges who hear precautionary measures exclusively.-

II. PURPOSE OF THE PRECAUTIONARY MEASURE

The plaintiff seeks a precautionary measure requesting that: “MUNICIPALIDAD DE QUEPOS be ordered immediately to suspend any (sic) construction work being carried out on the property of VISTA PARADISE MA S.R.L., Puntarenas property, real-property registry folio number 109617-000, until it is demonstrated that a construction permit has been obtained, or until otherwise ordered by a final and binding judgment issued by the same administrative-law jurisdiction”; in a submission filed on 10 de octubre de 2023, he expands the relief sought to request that: “SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN be ordered immediately to suspend the issuance of any tree-cutting permit for the property recorded under cadastral plan (plano catastro) P-501725-1998, located in Puntarenas, Quepos, Manuel Antonio, because this Project is located in an area deemed to be forest (bosque), which has an impact of high environmental fragility (fragilidad ambiental) (according to the reports issued by SINAC); this precautionary measure must remain in effect until a final and binding judgment is issued in these plenary proceedings (proceso de conocimiento)”; subsequently, in the filing dated 15 de diciembre de 2023, he again expands the relief sought, requesting that: “SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN AND THE STATE be ordered to halt the work and activities associated with the Proyecto Condominio Residencial Vista Islas, on the property recorded under cadastral plan P-501725-1998, located in Puntarenas, Quepos, Manuel Antonio, 2 kilometers south and 250 meters east of Condominio los Altos, because activities are being carried out in an area deemed to be forest, with a high environmental-fragility impact (according to reports issued by SINAC); the precautionary measure shall remain in effect until a final and binding judgment is issued in these ordinary proceedings (proceso ordinario).”-

III. ARGUMENTS OF THE MOVANT

The applicant relies on articles 41 and 50 of the Political Constitution, 10, 19, 20, 21, 22, 23, and 25 of the Contentious-Administrative Procedure Code, articles 11, 105, and 109 of the Biodiversity Law, and the case law of the Constitutional Chamber and the First Chamber of the Supreme Court of Justice of Costa Rica. Regarding the requirements: Likelihood of success on the merits (apariencia de buen derecho): the applicant states that the corporation is developing a construction project within a forest area and therefore requested that SETENA declare the absolute, evident, and manifest nullity (nulidad absoluta, evidente y manifiesta) of official communications SETENA-DT-ASA-0349-2002 of 21 de febrero del 2022 and SETENA-DT-ASA-1470-2022 of 8 de agosto del 2022, issued by the technical director of the Department of Environmental Audit and Monitoring, as well as issue a declaration of injuriousness (declaratoria de lesividad) concerning Environmental Viability License (Viabilidad Licencia Ambiental) number 1739-2017.

The applicant adds that the same case file contains evidence warranting the annulment of the project’s approval because it shows that the site was a forest area and that it was destroyed between 2013 and 2018, as evidenced by a complaint from 2006. Furthermore, the constitutional amparo proceeding (Recurso de Amparo), decision 2023-005950, shows that the respondent does not have a building permit and that SETENA has not ruled on the applicant’s absolute-nullity petition, and that the project affects the landscape. The applicant contends that the interim measure (medida cautelar) protects the principle of a healthy and ecologically balanced environment (article 50 of the Political Constitution), pursuant to the precautionary principle or in dubio pro natura standard (criterio precautorio o indubio pro natura) (articles 11 and 109 of the Biodiversity Law), because, given the threat of serious harm from the construction of a project without a building permit, the conservation of a forest ecosystem must be guaranteed and pursued; accordingly, the ex officio nullity proceeding (procedimiento de nulidad oficiosa) must first be decided, or a final and binding judgment must be issued in this judicial proceeding.

In a filing dated 10 de octubre de 2023, the applicant asserts that, according to reports ACOPAC-D-974-02, ACOPAC-CF-012-02, and ACOPAC-CF-013-02 of the Sistema Nacional de Áreas de Conservación, the Proyecto Condominio Residencial Vista Islas may be located on a site with forest cover (cobertura boscosa), in an area that technically meets the characteristics of a forest, and Ley Forestal prohibits land-use change (cambio de uso). The area even contains species typical of primary forest (bosque primario), such as Ceiba pentandra, Aspidosperma spruceanum, Termínalia oblonga, Calophyilum brasiliense, Garcínia madruno, and Platymiscium coruense; according to SINAC itself, this project would be located on class VIII lands, which are suitable as areas for preserving flora and fauna, protecting aquifer recharge areas, genetic reserves, and scenic beauty. Construction of the infrastructure entails the removal of vegetation and, consequently, loss of cover, as well as soil compaction, sealing, and erosion, which is not permissible under the country’s forestry and environmental legal framework.

Finally, in a brief added to the record on 15 de diciembre de 2023, the applicant states that Visual Inspection Report (Acta de Inspección Ocular) N° 44, dated 10 de diciembre del 2023, issued by the Sistema Nacional de Áreas de Conservación, orders the suspension of construction and activities. It ordered the immediate removal of machinery from the property associated with the Proyecto Condominio Residencial Vista Islas, which, as of today, has not been complied with. The Proyecto Condominio Residencial Vista Islas may be located on a site with forest cover, in an area that technically meets the characteristics of a forest, and Ley Forestal, article 19, prohibits land-use change; the applicant reiterates the arguments made in the previous filing. Risk from delay (peligro en la demora): The applicant asserts that article 74 of Chapter XVIII on Permits of the Construction Law establishes the obligation to obtain a building permit before carrying out any construction project in the country.

In the filing dated 10 de octubre de 2023, the applicant states that the serious harm arises from the clearing and loss of the forest to prepare the land at the sites where the project is located and in the area where earthworks (movimiento de tierras) are intended to alter the very steep slope, which would also affect another sector where the excavated material would be deposited, resulting in an abrupt change to the forest ecosystem existing in that area. Consequently, severe soil erosion would occur, and sediment would harm the stream, wetland, and mangrove, causing irreversible damage because the mitigation measures (medidas de mitigación) are insufficient to prevent or restore the ecosystem, according to SINAC in the cited reports. Construction of the project would entail the removal of vegetation, and the impact of falling trees on the regeneration intended to be retained would be greater than under any other percentage.

The clearings opened in the forest would be larger; therefore, the impact on the forest stand (masa boscosa) would be adverse because the harm to regeneration would be greater. According to SINAC, forest removal would adversely affect the fauna and the wild animal populations present in the area because, where the direction in which a tree falls cannot be controlled, it will create a larger clearing, directly affecting the habitat and animal species, some of which are endangered or threatened and some endemic to the region. Harm that would be extremely difficult or impossible to remedy would result, because the environmental damage caused by the project’s construction would directly affect populations of living organisms that require mobility, genetic exchange, and forested areas, and could cause a decline in biodiversity in the short, medium, and long term. In a brief added to the record on 15 de diciembre de 2023, the applicant states that the harm arises from construction work in an area that has undergone land-use change despite the prohibition in article 19 of Ley Forestal, constituting a serious violation of the provisions intended to preserve and properly manage forest resources; construction has continued even though an order suspending the work is in effect.

The prohibition under a special law against changing land use and establishing forest plantations on forest-covered land is not only a necessary measure for preserving biodiversity and ecosystem services and mitigating climate change, but also reflects a commitment to long-term sustainability. Balancing of the interests at stake (ponderación de los intereses en juego): the applicant contends that no public interest would be adversely affected; on the contrary, the constitutional right to a healthy and ecologically balanced environment would be guaranteed, along with the protection of natural resources against an illegitimate and unlawful private interest seeking to build a project without a building permit. In the filing dated 10 de octubre de 2023, the applicant states that granting the interim measure would not adversely affect any private interest; on the contrary, it would guarantee the constitutional right to a healthy and ecologically balanced environment, protected by the Political Constitution and the law, as well as safeguard natural resources against an illegitimate and unlawful private interest seeking to cut down trees in an area considered by SINAC to be forest.

Finally, in a brief added to the record on 15 de diciembre de 2023, the applicant states that granting the interim measure would not adversely affect any public interest; on the contrary, it would protect forest resources and safeguard them under the principle of a healthy and ecologically balanced environment (specifically, the land use in the area and its species), and reiterates the statements made in the previous filing.-

IV. ARGUMENTS OF THE RESPONDENTS

Municipalidad de Quepos: Likelihood of success on the merits (apariencia de buen derecho): it states that the project has municipal permit PC 249-2017 and, because it has a construction permit (permiso constructivo), it should not be suspended; it therefore considers the application for interim relief (solicitud cautelar) reckless. First supplemental submission: it states that the construction permit was issued upon compliance with environmental regulations and the environmental feasibility approval (viabilidad ambiental) 1739-2017 SETENA and its amendment SETENA-DT-ASA-0461-2021. There is scientific certainty that none of the circumstances under Article 11 of Ley de Biodiversidad is present. Risk arising from delay (peligro en la demora): it states that SETENA had granted environmental feasibility approval in 2017, but the same agency ordered the commencement of the works suspended until the original project was modified to protect the environment.

SETENA reviewed and approved the project last year and, in resolution 530-2023-SETENA, denied a motion for annulment (incidente de nulidad) against resolution 1739-1017-SETENA and official letters SETENA-DT-ASA-0349-2022 and SETENA-DT-ASA-1470-2022. It contends that there are no technical or scientific arguments in the case file that would even call SETENA’s decision into question and that SETENA, moreover, made clear that it has not approved any construction in forest areas (áreas de bosque). First supplemental submission: it argues that SETENA, the technical agency, approved the project and even reduced its scope, and in March denied the motion for annulment; resolution 530-2023-SETENA of 29 March 2023 makes clear that it does not approve any construction in forest areas, thereby refuting the applicant’s argument. Balancing of interests (ponderación de intereses): it states that SETENA’s decision last year prevails over the intentions of a private party who disagrees with that decision.

First supplemental submission: it reiterates its arguments and requests denial of the interim measure (medida cautelar). Second supplemental submission: it reiterates the foregoing and concludes that the proper procedure has been followed to carry out the construction project in compliance with environmental regulations, and that this must prevail over the mere intentions of a private party who objects without evidence in an attempt to discredit the actions taken by SETENA and SINAC. The State: Likelihood of success on the merits: it states that the applicant’s claim lacks merit; the new project has an environmental impact assessment license (licencia de evaluación de impacto ambiental), granted by SETENA pursuant to Article 46 BIS of Decreto Ejecutivo 31849-MINAE-S-MOPT-MAG-MEIC, which allows modifications to a previously assessed project to be approved without requiring the SETENA Plenary Commission to review the entire project again.

The project modification took into account the new environmental circumstances and the new SINAC official letters and reports submitted subsequently concerning the presence of a forest ecosystem (ecosistema de bosque). Accordingly, in resolution 1451-2020 at 9:45 a.m. on 19 August 2020, SETENA ordered the commencement of the construction phase suspended and required that the project be modified. Regarding the application for a declaration of absolute, clear, and manifest nullity (nulidad absoluta, evidente y manifiesta), it should be noted that it was decided by resolution 0530-2023-SETENA at 1:55 p.m. on 29 March 2023, which denied the motion for annulment against resolution 1739-2017-SETENA and official letters SETENA-DT-ASA-0349-2022 and SETENA-DT-ASA-1470-2022. It is emphasized that SETENA has not approved any construction in forest areas, as stated in resolution 0530-2023-SETENA at 1:55 p.m. on 29 March 2023.

First supplemental submission: it asserts that the precautionary and preventive principles (principios precautorio y preventivo) are implemented during the environmental impact assessment procedure (procedimiento de evaluación de impacto ambiental) conducted before SETENA, in which a series of studies are admitted and analyzed to determine, on the basis of science and the law, whether a given project is environmentally feasible, pursuant to Article 50 of the Constitución Política and Article 17 of the Ley Orgánica del Ambiente. In addition to the assertions made in the previous filing, it maintains that the land on which the project will be carried out, as well as the project itself, was reviewed by SINAC, which issued official letter SINAC-ACOPAC-OSREO-614-2019 of 12 November 2019 in response to SETENA’s inquiries regarding possible forest areas. It cannot be assumed, as the applicant seeks to suggest, that forest exists throughout the entire property on which the project is located, such that any application for a tree-cutting permit (permiso de corta) must be barred a priori.

The application for an interim measure is reckless and lacks merit because it relies on outdated information presented out of context regarding the land and the project analyzed by SETENA and SINAC. SINAC has the legal authority to grant or deny a permit for cutting trees on forested or non-forested land, pursuant to Articles 19 and 27 of the Ley Forestal and Articles 36 and 89 of the Reglamento a la Ley Forestal. The law does not expressly prohibit cutting trees on forested or non-forested land, provided that the requirements are met and SINAC grants approval following a technical and scientific analysis. Risk arising from delay: it states that the applicant alleges the existence of serious, actual, and individually identifiable harm because the project lacks a construction license (licencia constructiva), but the project in question does have a construction permit. The “Vistas Islas” project underwent an environmental assessment by SETENA in administrative file (expediente administrativo) D1-19369-2017 and obtained environmental feasibility approval through resolution 1739-2017-SETENA.

In resolution 1451-2020 at 9:45 a.m. on 19 August 2020, the commencement of the works was suspended because of a series of substantial changes in the project’s environmental conditions, pending modifications to protect the environment in light of the various reports issued after the environmental impact assessment and incorporated into the administrative file. Accordingly, official letter SETENA-DT-ASA-0349-2022 of 1 February 2022 approved the modification of the “Vistas Islas” project, which was subsequently amended by official letter SETENA-DT-ASA-1470-2022 of 8 August 2022, both issued by the Departamento de Auditoría y Seguimiento Ambiental pursuant to Article 46 BIS of the Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), Decreto Ejecutivo 31849-MINAE—SMOPT-MAG-MEIC. Consequently—in its view—there is no serious current or potential harm arising from the alleged absence of a construction license and environmental feasibility approval, as the applicant erroneously seeks to suggest, nor has any such harm been demonstrated.

First supplemental submission: it states that the claimant presents no evidence from which the alleged harm may be established. Moreover, suspending the issuance of tree-cutting permits lacks any instrumental connection or correlation with the alleged erosion damage, because slope removal (remoción de pendientes) or earthworks (movimientos de tierra) are unrelated to the issuance of a tree-cutting permit by Sistema Nacional de Áreas de Conservación (SINAC). The project obtained an environmental license (licencia ambiental) from SETENA, authorizing the works subject to the developer’s responsibility and strict compliance with environmental commitments (compromisos ambientales), in order to prevent erosion damage to the soil, biodiversity, and forest resources. It reiterates that the original project was ordered modified to prevent adverse impacts, in light of new documentation in the administrative file.

Sistema Nacional de Áreas de Conservación (SINAC) received an application for authorization to cut and/or harvest (autorización de corta y/o aprovechamiento) 23 trees in non-forest areas on 17 May 2022. This application was denied by resolution SINAC-ACOPAC-OSRAP-RES-021-2023 (see official letter SINAC-SE-DE-1536-023 of 06 November 2023). Thus, the Administration has acted to protect the environment and sustainable development, and there is therefore no harm or risk of harm to the forest ecosystem, as the applicant seeks to suggest, that would justify granting an interim measure ordering the suspension of every tree-cutting permit on the property corresponding to cadastral plan (plano de catastro) P-501725-1998. Interests at stake (intereses en juego): it states that the Administration has acted in accordance with the precautionary and sustainable-development principles by reassessing the project initially approved in light of the new environmental circumstances presented in the administrative file.

That action also observes the principles of legal certainty and legality (principios de seguridad jurídica y de legalidad) that govern a State under the rule of law (Estado de Derecho). In light of the foregoing, the protection of the public interest must continue to prevail in the judicial proceedings over any private interest the applicant may have. It notes a lack of standing (falta de legitimación), because the issuance of construction permits falls within the exclusive jurisdiction of each municipality. First supplemental submission: it asserts that the Administration has acted in accordance with the precautionary, sustainable-development, and legality principles. The public interest, duly protected by the national legal system, must prevail over an unsupported application for interim relief concerning the alleged losses and damages. Second supplemental submission: it states that record 44 of 10 December 2023, submitted by the applicant, demonstrates that SINAC issued a stop-work order (orden de paralización) for the activities being carried out within the property at issue in this litigation.

Therefore, the request that SINAC and the State be ordered to halt the works and activities associated with the Condominio Residencial Vista Islas project lacks a present interest, because the Administration has already ordered activities on that property halted. Through official letter SETENA-DT-ASA-0349-2022 of 21 February 2022 from Secretaría Técnica Nacional Ambiental, the developer was informed that compliance with the Environmental Impact Assessment (Evaluación de Impacto Ambiental) does not exempt it from completing the procedures required by other administrative authorities. Accordingly, the developer must address and demonstrate that the removal of trees from the land and the earthworks documented in the inspection record (acta de inspección) have the corresponding permits. SINAC: Likelihood of success on the merits: it maintains that Área de Conservación Pacífico Central (SUBREGIÓN AGUIRRE – hereinafter ACOPAP) has an application file for authorization to cut and/or harvest 23 trees, under file number PCPC03-IF-00035-2022.

On 19 April 2023, resolution N° SINAC-ACOPAC-OSRAP-RES-021-2023 denied authorization to cut and harvest 23 trees on the property recorded in Registro Nacional under registration number 6-109617-000; and on 17 October 2023, Vista Paradise MA SRL submitted a request to withdraw the appeal filed against that resolution. Mr. Brenes is not the person subject to the alleged harmful effects or the actual or individual harm claimed in the section on subjective admissibility (admisibilidad subjetiva). The application for an interim measure does not set forth a hypothetical assessment that would allow the judge to evaluate whether the claimant’s requested relief may or may not have any prospect of success and thus deem this requirement satisfied, particularly when there is no clear subject matter of the proceedings (objeto procesal). Supplemental submission: it states that the Administration is aware of file PC-03-DJ-030-23, in which work is being conducted jointly with Fiscalía Ambiental de Osa.

In official letter SINAC-ACOPAC-OSRAP-RF-128-2023 dated November 30, 2023, the Prosecutor’s Office was informed: “...several findings were obtained; as a result of the events, the following administrative orders were issued: SINAC-ACOPAC-OSRAP-OA-013-2023, SINAC-ACOPAC-OSRAPOA-014-2023, SINAC-ACOPAC-OSRAP-OA-015-2023, SINAC-ACOPAC-OSRAP-OA-016-2023, which require refraining from cutting or removing vegetation, transporting vegetation debris, or carrying out any other cutting or transportation activity; the obligation was imposed to safeguard the property seized immediately under report SINAC- ACOPAC-OSRAP-AD-005-2023 while the judge determines the provisional custody of the equipment, as well as seizure report SINAC- ACOPAC-OSRAP-AD-005-2023. These orders became immediately enforceable upon notification.” On December 10, 2023, following an inspection conducted jointly with OIJ, report SINAC-ACOPAC-PNMA-RBS-111-2023 was prepared in response to a reported incident involving earthworks (movimiento de tierra) and impacts on the natural resources of Islas of Manuel Antonio, addressed to the Assistant Prosecutor of the Environmental Prosecutor’s Office-Judiciary.

This report gave rise to record N°44, which sets forth the foregoing and orders the immediate suspension of the work and removal of the machinery from the site. In view of the foregoing, the case file is at the appeal stage, and administrative remedies have not yet been exhausted because two appeals remain pending resolution; once resolved, they would exhaust the administrative process. It argues that, although the appellant is correct regarding the principle of a healthy and balanced environment, SINAC has taken all appropriate measures by establishing an environmental commitment to protect the environment. Regarding the evidence offered by the plaintiff, this Administration’s actions are based on its administrative orders; nevertheless, the plaintiff attaches only one of them as evidence and is unaware of the joint work being carried out with the Osa Environmental Prosecutor’s Office. SINAC’s actions are intended to protect the environment; if anyone is harming the environment, as the plaintiff alleges, that is the person who should be reported.

The National System of Conservation Areas has taken no action granting a permit. Accordingly, there is no act or omission attributable to it. Periculum in mora (peligro en la demora): it contends that the plaintiff neither identifies the alleged loss and damage nor submits any evidence thereof. Even where the alleged harm is potential rather than actual, analyzing the likelihood of serious harm requires establishing a causal chain, at least through argument, that makes it possible to verify the link between the contemplated administrative action and the harm that the activity is alleged to be capable of causing; this is absent from the initial application. Regarding the supplemental application: it contends that the plaintiff submits no evidence of the alleged loss and damage, such as the performance of construction work in an area “that has undergone a land-use change (cambio de uso del suelo),” and thus merely presents a hypothetical situation.

Where the alleged harm is potential rather than actual, analyzing the likelihood of serious harm requires establishing a causal chain, at least through argument, that makes it possible to verify the link between the contemplated administrative action and the harm that the activity is alleged to be capable of causing; this is absent from the initial application. Balancing of the interests at stake (ponderación de los intereses en juego): it states that it does not observe the essential elements required for an interim measure (medida cautelar) to be ordered, since the balancing of public interests is unclear and the legitimate interest is not identified. It also explains that the plaintiff lacks standing (legitimación activa) to bring this proceeding, as established in Article 9 of the Code of Administrative Procedure, because, as shown by the documentary evidence offered by the plaintiff, there has been no action by this Administration against Mr.

Brenes; therefore, he is not the addressee of the alleged harmful effects. Instrumentality (instrumentalidad): it states that the plaintiff lacks standing pursuant to Article 9 of the CPCA. Regarding the supplemental application: it argues that, as the plaintiff states, “there is no public interest affected,” based on the proposition that “the forest resource would be protected and safeguarded under the principle of a healthy and ecologically balanced environment,” which SINAC is already doing. SINAC has granted no permit for land-use change. Moreover, the plaintiff does not establish what the legitimate interest is, and the plaintiff’s lack of standing to bring this proceeding is further explained, as established in Article 9 of the Code of Administrative Procedure, because, as shown by the documentary evidence offered by the plaintiff, there has been no action by this Administration against Mr.

Brenes; therefore, he is not the addressee of the alleged harmful effects. It reiterates the lack of standing pursuant to Article 9 of the CPCA. Vista Paradise MA SRL S.R.L: It states that there is no direct relationship between the relief sought and the purpose of the interim measure, which must help preserve certain conditions so that the nullity of acts or decisions may subsequently be declared; the plaintiff errs by attempting to create the impression that construction of the project should be suspended because it lacks a construction permit, when it does have one. Regarding the requirements for the interim measure: Likelihood of success on the merits (apariencia de buen derecho): the claim is unrelated to instrumentality, and the allegation, which appears to have been made in bad faith, presupposes that there is no construction permit and that the project must therefore be suspended.

Periculum in mora: it states that this is merely an allegation based on the erroneous assertion that there is no construction permit, and it attaches the permit. Balancing of the interests at stake: it contends that, because a construction permit has been obtained, the required procedure has been completed, thereby enabling development in harmony with the public interest and environmental protection; the project has SETENA’s approval. It refers to the plaintiff’s lack of standing, asserting that the plaintiff must prove the legal right or interest that has been infringed and that an environmental issue is not, by itself, a matter involving diffuse interests (intereses difusos) about which anyone may bring a claim. First supplemental application: it states that none of the plaintiff’s assertions and arguments are matters for discussion in a proceeding involving an application for an interim measure.

Such discussion is reserved for a determination on the merits in other types of proceedings. It requests that the unfounded and malicious application be denied and that the plaintiff be ordered to pay costs. Second supplemental application: it asserts that, in various filings, it has submitted evidence of the lawfulness of its actions: official letter SINAC-ACT-OSRN-780-2023 – from the State Forestry Authority indicating that the polygon where the project is being built is NOT forest; the construction permit issued by the Municipalidad de Quepos; the valid environmental approval for the project issued by SETENA; and the responses from the Procuraduría General de la República and MINAE requesting denial of the interim measure. As a result of an anonymous complaint, on December 10 last year, SINAC and OIJ, acting under the orders of Osa prosecutor Camilo Flores, appeared at the property and conducted a site inspection.

On the day of the inspection and subsequently in the Osa Prosecutor’s Office case file, we submitted the relevant evidence authorizing us to proceed with the commencement of the project, which the Prosecutor’s Office is analyzing to determine how to proceed with respect to the complaint. If the project has all permits required by law for its development, continuing to file anonymous complaints and submit arguments before this Court is simply an act of obstruction and pettiness. The project will bring hundreds of jobs to the area during both its construction phase and, eventually, its operational phase, as well as millions of dollars in direct investment, all of which will benefit an area in such great need. The applicant repeatedly continues to insist that this is a forest when, as we have demonstrated through evidence submitted in the case file, that is not the case. Therefore, there is no risk of serious harm, as the applicant claims merely by citing isolated provisions in an attempt to support his arguments, without submitting ANY evidence supporting his assertion and refuting ours.

Regarding the balancing of the interests at stake, it argues that the Procuraduría provided an extensive explanation concerning the public interest and the protected interests, wholly rejecting the applicant’s position. This is a case of procedural bad faith (mala fe procesal); it requests that the interim measure be denied.-

V. GENERAL CONSIDERATIONS REGARDING THE REQUIREMENTS FOR GRANTING AN INTERIM MEASURE

Case law has extensively developed the purpose of interim relief (justicia cautelar), which responds to the need to guarantee the constitutional principle of prompt and effective justice by preserving the factual conditions essential for rendering and enforcing the judgment. In this same vein, Article 19 of the Code of Administrative Litigation Procedure (Código Procesal Contencioso Administrativo) provides that the purpose of ordering an interim measure (medida cautelar) is to provisionally protect and safeguard the subject matter of the proceedings and the effectiveness of the judgment. Based on the foregoing, the adjudicating judge, in compliance with Article 21 of the aforementioned procedural law, must determine whether an application for an interim measure is admissible, verifying for that purpose that the claim in the proceedings on the merits (proceso de conocimiento) is neither reckless nor manifestly lacking in seriousness.

This entails a preliminary assessment of the merits to determine whether, in the case at issue, there is what legal scholarship and case law have called a likelihood of success on the merits (apariencia de buen derecho or fumus boni iuris). The provision under analysis also establishes that an interim measure is appropriate when the implementation or continuation of the conduct under review causes serious actual or potential harm or loss, a situation defined in legal scholarship as risk arising from delay (periculum en mora or peligro en la demora); that is, when, by virtue of the pathological delay inherent in judicial proceedings, there is a present, real, and objective risk that the moving party will suffer serious harm. Following the same line of reasoning, Article 22 of the Code of Administrative Litigation Procedure requires the adjudicating judge, in light of the principle of proportionality, to weigh the interests at stake: on the one hand, the individual’s circumstances and, on the other, the public interest, as well as the interests of third parties who may be affected by the adoption of the interim measure.-

VI. THE SPECIFIC CASE

  • a)Active standing (legitimación activa). One of the arguments raised is that Lic. Wálter Brenes Soto lacks active standing in this matter pursuant to article 9 of the Administrative Litigation Procedural Code (Código Procesal Contencioso Administrativo), since no action has been taken against him and he is not the recipient of the harmful effects. In this regard, it must be noted that section 105 of the Biodiversity Law (Ley de Biodiversidad) provides: “Citizen action (Acción popular). Every person shall have standing to bring an action before an administrative or judicial body in defense and protection of biodiversity”; therefore, under this special law, it is clear that the present matter may be brought by any person because it constitutes a citizen action, bearing in mind the purpose of that law as stated in article 1: “The purpose of this law is to conserve biodiversity and ensure the sustainable use of resources, as well as to distribute the resulting benefits and costs fairly.” b) The relief sought through the precautionary measure (medida cautelar) included in the initial application and the first expansion of 10 de octubre de 2023: For purposes of issuing the appropriate ruling concerning the precautionary measure sought, this judge considers it necessary to conduct a separate analysis of the initial forms of relief sought through the precautionary measure included in the initial application and in the expansion, which concern the following: “The MUNICIPALIDAD DE QUEPOS shall be ordered immediately to suspend forthwith any construction work being performed on the property of VISTA PARADISE MA S.R.L, property in Puntarenas, real-property folio registration number 109617-000, until it is demonstrated that a building permit has been obtained, or until otherwise ordered by a final and binding judgment issued by the same administrative-litigation jurisdiction (jurisdicción contencioso-administrativa)” and “The SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN shall be ordered to suspend immediately the granting of any tree-felling permit (permiso de corta de árboles) for the property identified by cadastral plan (plano catastro) P-501725-1998, located in Puntarenas, Quepos, Manuel Antonio, because this Project is situated in an area regarded as forest (bosque), with a high environmental-fragility impact (impacto de alta fragilidad ambiental) (according to reports issued by SINAC); this precautionary measure shall remain in effect until a final and binding judgment is issued in these proceedings on the merits (proceso de conocimiento).” This is because the record establishes that the company VISTA PARADISE MA SRL S.R.L. does in fact hold building permit PC 249-2017, granted by the Municipalidad de Quepos (see images 103, 192, 533, 564, 716, 747 of the judicial case file), which was the outcome sought; consequently, the precautionary measure lacks a continuing legal interest (interés) with respect to this relief.

Regarding the relief sought in the first expansion of the precautionary measure, the evidence shows that SINAC processed an authorization to fell and/or harvest (autorización de corta y/o aprovechamiento) 23 trees in case file PCPC03-IF-00035-2022 and that resolution SINAC-ACOPAC-OSRAP-RES-021-2023 (see images 316 to 330 of the precautionary-measures case file) denied that felling and harvesting of trees on property registration number 6-109617-000. Subsequently, on 27 de noviembre de 2023, seizure record (acta de decomiso) SINAC-ACOPAC-OSRAP-AD-005-2023 was issued, warning the party “to refrain from felling and/or removing vegetation, transporting vegetation debris, or engaging in any other felling or transportation activity, and imposing the obligation to safeguard the property seized under record ACOPAC-USRAP-AD-005-2023....” Similarly, Administrative Order Record (Acta Orden Administrativa) SINAC-ACOPAC-OSRAP-OA-014-2023 of 27 de noviembre de 2023, Administrative Order Record SINAC-ACOPAC-OSRAP-OA-015-2023 of 27 de noviembre de 2023, and Administrative Order Record SINAC-ACOPAC-OSRAP-OA-016-2023 of 27 de noviembre de 2023 all order the party to refrain from any activity involving the harvesting, felling, and/or removal of vegetation (images 591 to 592, 593 to 594, 595 to 596, and 597 to 598 of the case file).

It may therefore be concluded that there is no pending application for a tree-felling permit for that property that must be suspended; on the contrary, actions are being undertaken jointly with the Prosecutor’s Office (Fiscalía) to determine whether any irregularities exist, according to report SINAC-ACOPAC-OSRAP-RF-128-2023 of 30 de noviembre del 2023, addressed to Environmental Prosecutor for Osa Lic. Camilo Roberto Flores Pacheco (see images 582 to 589). c) The third form of relief sought (the second expansion): This request seeks the following: “The SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN AND THE STATE shall be ordered to halt the work and activities associated with the Proyecto Condominio Residencial Vista Islas on the property identified by cadastral plan P-501725-1998, located in Puntarenas, Quepos, Manuel Antonio, 2 kilometers south and 250 meters east of Condominio los Altos, because activities are being carried out in an area regarded as forest, with a high environmental-fragility impact (according to reports issued by SINAC); the precautionary measure shall remain in effect until a final and binding judgment is issued in these ordinary proceedings (proceso ordinario).” With respect to this request, the Court will examine the requirements for a precautionary measure (presupuestos de la medida cautelar) established by articles 21 and 22 of the Administrative Litigation Procedural Code, in light of the parties’ arguments and the evidence submitted to the case file. 1.

Likelihood of success on the merits (Apariencia de buen derecho): A preliminary analysis of the application shows that the theory of the case (teoría del caso) presented is reasonably substantiated, such that—without assessing the merits, which is not appropriate in these precautionary proceedings (proceso cautelar)—the action brought is deemed neither reckless nor lacking in seriousness. In other words, the likelihood-of-success requirement is satisfied because the matter is capable of adjudication in proceedings on the merits, and examination of the merits exceeds the scope of a precautionary ruling (resolución cautelar). 2. Risk arising from delay (Peligro en la demora): The applicant (gestionante) refers essentially to environmental damage resulting from the clearing and loss of forest and vegetation to prepare the land; in the locations where it is situated and in the area where earthworks (movimiento de tierras) are planned to alter the very steep slope, severe soil erosion will occur and sediment will harm the stream, wetland, and mangrove, causing irreversible damage because the mitigation measures (medidas de mitigación) are insufficient to prevent the damage or restore the ecosystem.

There will be a negative impact on fauna from the clearing of the forest and on the wild-animal populations present in the area because their habitat and animal species—some endangered or threatened—will be directly affected. Construction work is being performed in an area that has undergone a land-use change (cambio de uso del suelo), despite the prohibition in article 19 of the Ley Forestal, which constitutes a serious violation of the provisions intended to preserve and properly manage forest resources, and construction is continuing even though a stop-work order (orden de paralización de obras) exists. Prohibiting land-use change under a special law and the establishment of forest plantations (plantaciones forestales) on forest-covered land is not only necessary to preserve biodiversity and ecosystem services and mitigate climate change, but also reflects a commitment to long-term sustainability.

In this regard, this Court, in compliance with the legal system and in fulfillment of its duty to protect the environment, begins with the provisions of section 50 of the Constitución Política, which establishes the right to a healthy and ecologically balanced environment and gives rise to the State’s obligation to ensure its proper protection. Within this protective framework, our legal system contains extensive legislation protecting the environment, as well as constitutional case law (jurisprudencia Constitucional) and precedents from this Court on the matter. These develop principles such as in dubio pro natura, the precautionary principle (principio precautorio), the preventive principle (principio preventivo), “the polluter pays” (“quien contamina paga”), and restoration in kind (reparación in natura), among others, all of which are relevant and must be weighed by the adjudicator (persona juzgadora) in safeguarding the environment.

Regarding precautionary relief (justicia cautelar), the test of serious actual or potential harm or loss, as a means of defining the risk-arising-from-delay requirement, varies in the environmental context: “...the foregoing requirements must be assessed in accordance with the substance of the principles permeating environmental law; otherwise, that right could be deprived of substance and environmental damage could be permitted through omission, to the detriment of people’s rights” (as stated in resolution number 250-2010 of this Court, issued at eight hours on veintinueve de enero del dos mil diez). It is clear that any intrusive human conduct posing a probable environmental impact requires precautionary protection (tutela cautelar) under the precautionary principle, which does not require scientific proof of harm, as provided in article 11 of the Biodiversity Law. Regarding reversal of the burden of proof (inversión de la carga de la prueba), this means that the defendant is responsible for offering evidence to rebut the substance of the claim, considering that Environmental Law (Derecho Ambiental) seeks to prevent harm rather than remedy it.

Article 109 of the Biodiversity Law provides: “The burden of proving the absence of unauthorized pollution, degradation, or impact shall rest with the person requesting approval, permission, or access to biodiversity, or with the person accused of causing environmental damage.” It should be borne in mind that no express statement by the adjudicator is required in this regard, since this matter is governed by law. This departs from the traditional rule that “the person who asserts must prove” (“quién afirma prueba”) and places us within the doctrine of the shifting burden of proof (teoría de carga dinámica de la prueba), under which the burden of proof is transferred “...to whichever party, by virtue of that party’s particular circumstances, is in a better position to bring the evidence into the proceedings, regardless of whether that party is the plaintiff or the defendant” (see judgment 212-2008, issued at 8:15 hours on 25 de marzo de 2008).

Accordingly, in situations involving a potential impact on the environment, “...for the adjudicator to decide to grant a precautionary measure in defense of the environment, certainty and immediacy of the risks would suffice, even if existing harm to the environment or health has not been proven, for protection to become effective” (see González Ballar, Rafael and Peña Chacón, Mario: El Proceso Ambiental en Costa Rica, 1a. edición, San José, 2015, p.163). In other words, within a logical and reasoned analysis, protection against the possibility of harm becomes relevant, and it is unworkable to apply a standard requiring actual harm, which would be counterproductive because, once the harm occurs, it may be irreversible or impossible to remedy.-

VII.Although environmental matters have the breadth described above, this Judge considers that environmental risks must be certain and current—without requiring proof of actual harm—and, as this Court stated in judgment number 250-2010 of eight hours on the twenty-ninth of January of two thousand ten, “...a person seeking an interim measure (medida cautelar) with suspensive effect, as in this case, or of any other kind, is not entirely relieved of the duty to prove, or at least to demonstrate objectively and on a reasoned basis, the potential risks that a particular action may cause to the interest sought to be protected, as well as the other requirements established by section 21 of the Code of Contentious-Administrative Procedure (Código Procesal Contencioso Administrativo) for granting interim relief. The duty to prove the existence of these indispensable conditions is subject to no exception for measures relating to the environment” (emphasis not in the original).

It should be noted from the record that the moving party offers evidence of environmental risk and submits videos on compact disc, photographs, and a technical opinion concerning the Vista Islas project in Quepos Manuel Antonio (see images 817 to 830), issued by Engineer Paola Hernández Rodríguez, a Forestry Engineer, which concludes: “The area shown on plan P-501725-1998, located in Manuel Antonio de Quepos, where the Vista Islas de Manuel Antonio project is intended to be carried out, constitutes forest, and has undergone land-use change (cambio de uso) (...) At present—and the location is not described in detail in this report—it is completely devoid of vegetation....” Additionally, and constituting decisive evidence in this matter, there is SINAC-ACOPAC-OSRAP-AD-005-2023, the seizure record (acta de decomiso), which orders the project developer “to refrain from cutting and/or removing vegetation, transporting vegetation debris, or engaging in any other cutting or transportation activity; the obligation to safeguard the seized property is imposed through record ACOPAC-USRAP-AD-005-2023....” There are also Administrative Order Record SINAC-ACOPAC-OSRAP-OA-014-2023, Administrative Order Record SINAC-ACOPAC-OSRAP-OA-015-2023, and Administrative Order Record SINAC-ACOPAC-OSRAP-OA-016-2023 of November 27, 2023, all dated November 27, 2023, ordering the parties to refrain from any harvesting, cutting, and/or removal of vegetation (images 591 to 592, 593 to 594, 595 to 596, and 597 to 598 of the case file); and report SINAC-ACOPAC-OSRAP-RF-128-2023 of November 30, 2023, addressed to Osa Environmental Prosecutor Lic. Camilo Roberto Flores Pacheco (see images 582 to 589), which states: “...Fourth.

At the time of the inspection, Mr. Quirós Elizondo did not have a Certificate of Origin (Certificado de Origen, CO) or a harvesting permit (permiso de aprovechamiento) from the State Forestry Administration (Administración Forestal del Estado, AFE). (...) Sixth. It was observed that several trees had been harvested within the property; the stumps found were georeferenced and their possible species were verified. The stumps found are shown on the following map: (...) Seventh. Based on the stumps found during the inspection, it was determined with the assistance of Qgis 3.24 that their locations match those of the trees for which harvesting was requested in the Forest Inventory (Inventario Forestal) processed under administrative expediente PC-03-IF-009-2022 (SICAF: PC-PC03-IF-035-2022), as shown on map 2. Harvesting was denied through administrative resolution SINAC-ACOPAC-OSRAP-RES-031-2022 because the trees were located within a forest ecosystem; the matter is currently pending resolution of an appeal before the Consejo Nacional de Áreas de Conservación (CONAC).

The stumps of two palm trees were also found. Eighth. At the time of the inspection, the stump of the tree marked number 27 in the submitted forest inventory could not be found (see map 2), because the guardhouse is currently located in this sector and, next to it, a metal lookout-type structure is being erected, built with square purlins and measuring approximately 2 meters wide and 10 meters long. Tenth. A Caterpillar backhoe, license plate EE40222, driven by Mr. Juan Carlos Fallas González, identification card 6 0355 0398, was at the site performing earthworks (movimiento de tierra) and moving debris resulting from the forestry-harvesting activities (branches and trunks) carried out there. Eleventh. A Mack dump truck, license plate C137849, driven by Mr. Fabio Alberto Leandro Gatgens, identification card 6 0275 0584, was also at the site transporting soil and portions of branches and trunks.

Twelfth. The felled trees were completely cut into pieces (chipped) at the site, and the waste was being transported to a municipal dumping site in the Paquita de Quepos sector, as indicated by the project manager. (...) Seventeenth. An inspection of the property was conducted, and it was observed that underbrush clearing (socola) had been carried out throughout the forest area. The affected area was inspected and georeferenced, and it was determined that there is a small underbrush-cleared area of approximately 280 m2 in the northwestern sector. This practice was also observed from the northeastern sector southward, as shown by the inspection route (see map 3); an underbrush-cleared area of approximately 12 000 m2 is estimated in this sector” (emphasis does not appear in the original document); and record 44 of December 10, 2023, submitted by the party seeking the interim measure, which orders that the work be halted and the machinery removed (see images 438 and 439).

Ultimately, where environmental risk or potential harm is alleged, it is imperative to weigh the burden of proof (carga probatoria) under the in dubio pro natura, precautionary, and preventive principles, so that the Judge may consider the objective probability and the foreseeable and objectively assessed risk that an act or omission may, with or without scientific measurement, adversely affect the environment. The Judge must properly value environmental protection and must not wait for the harm to occur, since in most cases remediation will be impossible (as stated in the repeatedly cited judgment of this Court, 250-2010 of eight hours on the twenty-ninth of January of two thousand ten). Regarding the burden of proof in these proceedings (Article 109 of the Ley de Biodiversidad), this Judge observes that the State’s representative did not discharge its procedural burden, but merely stated that record 44 of December 10, 2023 demonstrates that SINAC ordered the activities halted and maintained that the interim measure was moot.

To the contrary, this Judge finds that SINAC has undertaken a series of actions aimed at protecting the environment, as demonstrated by the evidence submitted, and Vista Paradise MA SRL S.R.L. has likewise failed to demonstrate in this case file that it caused no environmental harm, a burden that also rested upon it. Accordingly, there is sufficient convincing evidence to establish the existence of environmental risks or threats, and this requirement is therefore satisfied. 3. Balancing of interests (ponderación de intereses). This Judge considers that there is a relationship between the environment and human activity; therefore, this final requirement must be examined in detail in light of the interests involved. In this matter, and consistent with the foregoing discussion of the risk arising from delay (peligro en la demora), the public interest embodied in the right to a healthy and ecologically balanced environment must prevail.

That right concerns neither one person nor one group but is a general interest, as opposed to the private interest of the company developing the Proyecto Condominio Residencial Vista Islas on property 6-109617-000, registered survey plan P-501725-1998, owned by Vista Paradise MA SRL S.R.L.; accordingly, this requirement is satisfied. Consequently, because all necessary statutory requirements are met, the third claim in the requested interim measure must be granted. As to today’s request for certification of the ruling issued at fifteen hours and thirty-seven minutes on the fifteenth of May of two thousand twenty-four, processed in expediente number 18-000027-0611-PE, the application is denied as unnecessary in view of the manner in which this matter is decided. The matter is decided without a special award of costs (costas).-

POR TANTO

The requested interim measure is declared PARTIALLY GRANTED. It is granted solely insofar as the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN AND THE STATE (SETENA) are ordered to halt the works and activities associated with the Proyecto Condominio Residencial Vista Islas on the property identified by registered survey plan P-501725-1998, located in Puntarenas, Quepos, Manuel Antonio, because activities are deemed to be taking place in an area classified as forest, with high environmental impact and fragility. In addition, they are ordered to submit, WITHIN A MAXIMUM PERIOD OF ONE MONTH, a study to determine the environmental impact caused in the area concerned. To the extent not expressly granted, the application for interim relief is denied. As to the request for certification of the ruling issued at fifteen hours and thirty-seven minutes on the fifteenth of May of two thousand twenty-four, processed in expediente number 18-000027-0611-PE, the application is denied as unnecessary. RESULTANDO

1- En fecha 01 de agosto de 2023 el gestionante en horario de disponibilidad promueve medida cautelar (ver memorial en imágenes 2 a 12 del expediente de medida cautelar).- 2- En resolución de las veintiún horas con treinta y ocho minutos del primero de agosto del año dos mil veintitrés, se rechaza la medida cautelar provisionalísima y se otorga audiencia de gestión cautelar a las demandadas (ver imágenes 51 a 54 del expediente de medida cautelar).- 3- En memorial presentado el 13 de setiembre de 2023 la sociedad Vista Paradise MA SRL S.R.L. se refiere a la medida cautelar y solicita se rechace (ver imágenes 74 a 91 del expediente de medida cautelar).- 4- La representación estatal solicita la denegatoria del requerimiento cautelar por improcedente (ver imágenes 199 a 205 del expediente de medida cautelar).- 5- La representaciones de la Municipalidad de Quepos se refiere a la medida cautelar incoada (ver imágenes 262 a 265 del expediente de medida cautelar).- 6- El gestionante amplía argumentos, aporta prueba y amplia la pretensión (ver imágenes 266 a 275 del expediente).- 7- En resolución nueve horas treinta minutos del uno de noviembre de dos mil veintitrés se concede audiencia de la ampliación de la medida cautelar incorporando al SINAC (ver imagen 276 del expediente de medida cautelar).- 8- Las representaciones de la Municipalidad de Quepos, Vista Paradise MA SRL S.R.L., Sistema Nacional de Áreas de Conservación, el Estado se refieren a la ampliación de la medida cautelar (ver imágenes 283 a 287, 300, 302 a 309, 352 a 360 del expediente cautelar).- 9- El gestionante vuelve a ampliar argumentos (ver imágenes 289 a 291 del expediente cautelar).- 10- El gestionante aporta prueba para mejor resolver (ver imágenes 338 y 339 del expediente cautelar).- 11- El 15 de diciembre de 2023, el gestionante una vez más amplía argumentos y pretensión (ver imágenes 427 a 432 del expediente cautelar).- 12- Mediante resolución catorce horas doce minutos del diez de enero de dos mil veinticuatro, se concede audiencia de la prueba para mejor resolver y se solicita aclaración del escrito del 15 de diciembre de 2023 (ver imágenes 442 y 443 del expediente cautelar).- 13- Por auto de las quince horas cincuenta y siete minutos del quince de enero de dos mil veinticuatro, se otorga audiencia de la ampliación de la medida cautelar (ver imagen 452 del expediente cautelar).- 14- Las representaciones de la Municipalidad de Quepos, el Estado, Sistema Nacional de Áreas de Conservación se refieren a la ampliación de la medida cautelar (ver imágenes 468 a 472, 475, 479 a 486 del expediente cautelar).- 15- El primero de marzo de 2024 el gestionante incorpora a los autos prueba para mejor resolver (ver imágenes 814 y 815 del expediente cautelar).- 16- En resolución de las trece horas cinco minutos del once de marzo de dos mil veinticuatro, se confiere audiencia de la prueba para mejor resolver (ver imagen 831 del expediente).- 17- En los procedimientos se han observado las prescripciones de rigor y no se notan causales de nulidad capaces de invalidar lo actuado.-

CONSIDERANDO

I. GESTIONES DE PRONTO DESPACHO

El promovente de la presente medida cautelar ha presentado sendas gestiones de pronto despacho y alega "...que desde fecha 4 de agosto de 2023 se interpuso la medida cautelar sin que a la fecha exista resolución por parte de esta autoridad judicial", sin embargo, pierde de vista que él mismo ha propiciado que no se haya resuelto este asunto con anterioridad siendo que ha promovido múltiples ampliaciones y ha incorporado en varias ocasiones prueba para mejor resolver, situación que genera cierta confusión en el expediente; y en resguardo del debido proceso y al derecho de defensa se ha concedido audiencia a las partes involucradas de cada escrito e incluso se aclaró en resolución de las trece horas cuarenta y siete minutos del veinticinco de setiembre de dos mil veintitrés: "...una vez notificada la presente gestión cautelar a todas las partes y vencido el plazo para contestar, se remitirá el expediente para fallo, a fin de que sea resuelto según el orden que por turno corresponda.

Tomen nota las partes, que los asuntos se van resolviendo según el lugar que vayan ocupando en la casilla de pase a fallo, es decir, del más antiguo de ingresar a dicha casilla al de más reciente ingreso en la tarea, siguiendo la máxima de primero en tiempo primero en derecho"; por ello se resuelve esta gestión cautelar en el turno que corresponde considerando, adicionalmente que el promovente no cumple con los criterios de vulnerabilidad de usuarios para una atención prioritaria aunque este Tribunal no desconoce la importancia del tema ambiental y el Despacho no cuenta con Juzgadores que conozcan únicamente medidas cautelares.-

II. OBJETO DE LA MEDIDA CAUTELAR

La parte actora promueve medida cautelar a efectos de que: "Se ordene de inmediato a la MUNICIPALIDAD DE QUEPOS la suspensión inmediata de cualquieras (sic) obras constructivas que se están ejecutando en la propiedad de VISTA PARADISE MA S.R.L, finca de Puntarenas, matrícula folio real número 109617-000, hasta tanto se demuestre se cuente con permiso constructivo, o se proceda a disponer lo contrario, mediante sentencia final y firme, que sea emitida por la misma jurisdicción contencioso - administrativa", en memorial presentado el 10 de octubre de 2023 amplía la pretensión con el objeto de que: "Se le ordene al SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN la suspensión inmediata del otorgamiento de cualquier permiso de corta de árboles, en la propiedad con plano catastro P-501725-1998, ubicada en Puntarenas, Quepos, Manuel Antonio, lo anterior por encontrarse este Proyecto en una zona considerada como bosque, la cual tiene un impacto de alta fragilidad ambiental (conforme a los informes emitidos por el SINAC), esta medida cautelar debe mantenerse hasta tanto se emita sentencia firme y definitiva en este proceso de conocimiento", posteriormente, en escrito del 15 de diciembre de 2023, nuevamente amplía la pretensión, con el fin que: "Se ordene al SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN Y AL ESTADO ejecutar la la paralización de obras y de actividades asociadas al Proyecto Condominio Residencial Vista Islas, en la propiedad con plano catastro P-501725-1998, ubicada en Puntarenas, Quepos, Manuel Antonio, del Condominio los Altos, 2 kilómetros al sur y 250 metros al este, lo anterior por estar realizando actividades en una zona considerada como bosque, con un alto impacto de fragilidad ambiental (conforme a informes emitidos por el SINAC), debiendo la medida cautelar mantenerse hasta tanto se emita la sentencia firme y definitiva dentro de este proceso ordinario".-

III. ARGUMENTOS DEL PROMOVENTE

El gestionante se fundamenta en los artículos 41 y 50 de la Constitución Política, 10, 19, 20, 21, 22, 23 y 25 del Código Procesal Contencioso Administrativo, artículo 11, 105 y 109 de la Ley de Biodiversidad, en la jurisprudencia de la Sala Constitucional y de la Sala Primera de la Corte Suprema de Justicia de Costa Rica. En cuanto los presupuestos: Apariencia de buen derecho: señala que la sociedad desarrolla un proyecto constructivo dentro de una zona de bosque y por ello solicitó a SETENA la declaratoria de la nulidad absoluta, evidente y manifiesta del oficio SETENA-DT-ASA-0349-2002 del 21 de febrero del 2022 y SETENA-DT-ASA-1470-2022 del 8 de agosto del 2022 emitidos por el director técnico del Departamento de Auditoria Seguimiento Ambiental, así como la declaratoria de Iesividad de la Viabilidad Licencia Ambiental número 1739-2017. Agrega, que en el mismo expediente existe prueba para decretar la anulación de la aprobación del proyecto porque consta que era una zona de bosque y en el año 2013 a 2018 se destruyó como consta denuncia del 2006.

Además, que en Recurso de Amparo voto 2023-005950, evidencia que el accionado no cuenta con licencia de construcción y que SETENA no ha resuelto su gestión de nulidad absoluta y el proyecto afecta el paisaje. Sostiene que la medida cautelar tutela el principio a un ambiente sano y ecológicamente equilibrado (artículo 50 de la Constitución Política), en aplicación del criterio precautorio o indubio pro natura (artículo 11 y 109 de la Ley de Biodiversidad), por cuanto existiendo una amenaza de daños graves por la construcción de un proyecto sin licencia constructiva, debe garantizar y buscarse la conservación de un ecosistema de bosque, en tanto, debe primero resolverse el procedimiento de nulidad oficiosa o dictarse sentencia final y en firme en este proceso judicial. Con escrito del 10 de octubre de 2023: afirma que: según los informes ACOPAC-D-974-02, ACOPAC-CF-012-02 y ACOPAC-CF-013-02, del Sistema Nacional de Áreas de Conservación, el Proyecto Condominio Residencial Vista Islas podría encontrarse en un sitio de cobertura boscosa siendo una zona que técnicamente cumple con las características de bosque y la Ley Forestal prohíbe el cambio de uso.

Incluso en esa zona se encuentran especies típicas de bosque primario como Ceiba pentandra, Aspidosperma spruceanum, Termínalia oblonga, Calophyilum brasiliense, Garcínia madruno y Platymiscium coruense; según el mismo SINAC, este proyecto se encontraría ubicado en terrenos de clase VIII, siendo este tipo de tierras útiles como zonas de preservación de flora y fauna, para protección de áreas de recarga acuífera, reserva genética y belleza escénica. La construcción de la infraestructura conlleva a la eliminación de vegetación y con esto, la pérdida de cobertura, la compactación, impermeabilización y erosión del suelo, Io cual no es viable en cumplimiento del marco forestal y ambiental del país. Finalmente, en memorial incorporado el 15 de diciembre de 2023: indica que el Acta de Inspección Ocular N° 44 de fecha 10 de diciembre del 2023 del Sistema Nacional de Áreas de Conservación, ordena la paralización de obras y de actividades.

Ordenó, retirar la maquinaria de la propiedad asociada al Proyecto Condominio Residencial Vista Islas, de manera inmediata, lo cual, a hoy, no se cumple. El Proyecto Condominio Residencial Vista Islas, podría encontrarse ubicado en un sitio de cobertura boscosa, zona que técnicamente cumple con las características de un bosque y la Ley Forestal, artículo 19, prohíbe el cambio de uso y reitera argumentos del escrito anterior. Peligro en la demora: Afirma que el artículo 74 del Capítulo XVIII de Licencias de la Ley de Construcciones, establece la obligación de contar con licencia constructiva, para ejecutar cualquier proyecto constructivo en el país. En escrito del 10 de octubre de 2023 señala que: el grave daño subyace por un proceso de eliminación y pérdida del bosque para limpieza del terreno, en los sitios en que se ubica y el área donde se pretende realizar el movimiento de tierras para cambiar la pendiente tan pronunciada, teniendo que afectarse otro sector donde se colocará el material de la remoción, lo cual representará un cambio brusco al ecosistema de bosque existente en esa zona.

Consecuentemente, se ocasionará una alta erosión del suelo y los sedimentos perjudicarán la quebrada, el humedal y el manglar, causando daños irreversibles dado que las medidas de mitigación no son suficientes para evitar o recobrar el ecosistema, según el SINAC en los informes que se cita. La construcción del proyecto conllevará la eliminación de la vegetación, el impacto de la caída de árboles sobre la regeneración que se pretendía dejar siendo mayor que en cualquier otro porcentaje. Los claros que se abren en el bosque son mayores, por lo tanto, el impacto sobre la masa boscosa es negativo porque el daño sobre la regeneración es mayor. Según el SINAC, el impacto sobre la fauna en la eliminación de bosque, de las poblaciones de animales silvestres presentes en el área, van a recibir un impacto negativo, porque en circunstancias donde no se puede dar una dirección de caída a un árbol y va a crear un claro mayor, afectando directamente el hábitat y las especies animales algunas en peligro de extinción o amenazadas, algunas endémicas de la región.

Se ocasionarían daños de muy difícil o imposible reparación, ya que el recuento de daños ambientales con la construcción del proyecto impactará directamente en poblaciones de seres vivos que necesitan movilización, intercambio genético, área boscosa y podría ocasionar la disminución de biodiversidad a corto, mediano y largo plazo. Y en memorial incorporado el 15 de diciembre de 2023: señala que el daño subyace por la realización de obras de construcción en un área que ha experimentado un cambio de uso del suelo, a pesar de la prohibición del artículo 19 de la Ley Forestal, que constituye una infracción seria a las disposiciones destinadas a preservar y gestionar adecuadamente los recursos forestales, donde incluso a pesar de existir orden de paralización de obras, siguen construyendo. La prohibición de cambiar el uso del suelo de una ley especial y establecer plantaciones forestales en terrenos cubiertos de bosque no solo es una medida necesaria para preservar la biodiversidad, los servicios ecosistémicos y mitigar el cambio climático, sino que también refleja un compromiso con la sostenibilidad a un largo plazo.

Ponderación de los intereses en juego: sostiene que no existe ningún interés público afectado, al contrario, se garantiza el derecho constitucional a un ambiente sano y ecológicamente equilibrado, el resguardo de los recursos naturales frente a un interés privado ilegítimo e irregular, por pretenderse la construcción de un proyecto sin licencia constructiva. En escrito del 10 de octubre de 2023, manifiesta que si se acoge la medida cautelar no existe ningún interés privado afectado, al contrario, se garantiza el derecho constitucional a un ambiente sano y ecológicamente equilibrado, resguardado por la Constitución Política y la ley, así como el resguardo de los recursos naturales frente a un interés privado ilegítimo e irregular, que pretende la corta de árboles en una zona considerada por SINAC como bosque. Finalmente, en memorial incorporado el 15 de diciembre de 2023: De acogerse la medida cautelar no existe ningún interés público afectado, al contrario, se estaría protegiendo el recurso forestal, resguardando bajo el principio de un ambiente sano y ecológicamente equilibrado (específicamente el uso de suelo de la zona y sus especies) y reitera lo indicado en el escrito anterior.-

IV. ARGUMENTOS DE LAS DEMANDADAS

Municipalidad de Quepos: Apariencia de buen derecho: señala que la misma cuenta con permiso municipal PC 249-2017 y al contar con permiso constructivo no tendría que suspenderse, por ello considera que la solicitud cautelar es temeraria. Primera ampliación: señala que consta el permiso de construcción a partir del cumplimiento de la normativa ambiental y la viabilidad ambiental 1739-2017 SETENA y su modificación SETENA-DT-ASA-0461-2021. Hay certeza que científica que no estamos en ninguna situación del artículo 11 de Ley de Biodiversidad. Peligro en la demora: indica que SETENA había otorgado la viabilidad ambiental desde 2017 pero el mismo ente, ordenó la suspensión del inicio de las obras hasta que se modificara el proyecto original en protección del ambiente. SETENA revisó y aprobó el proyecto el año pasado y rechazó en resolución 530-2023-SETENA un incidente de nulidad contra la resolución 1739-1017-SETENA y oficios SETENA-DT-ASA-0349-2022 y SETENA-DT-ASA-1470-2022, considera que no hay argumentos técnicos o científicos dentro del expediente para pensar siquiera que SETENA e incluso, deja claro que no ha avalado ninguna construcción en áreas de bosque.

Primera ampliación, argumenta que el ente técnico SETENA aprobó el proyecto e incluso lo modificó a la baja y en marzo rechazó el incidente de nulidad promovido y deja claro en resolución 530-2023-SETENA del 29 de marzo de 2023, que no avala ninguna construcción en áreas de bosque, borrando el argumento del solicitante. Ponderación de intereses: indica que lo decidido por SETENA el año pasado, prevalece contra la intención de un privado que no está de acuerdo con lo resuelto. Primera ampliación: reitera sus argumentos y solicita el rechazo de la medida cautelar. Segunda ampliación: reitera lo dicho y concluye que se ha dado el trámite correcto para llevar a cabo el proyecto constructivo en cumplimiento de la normativa ambiental y debe prevalecer de la simple intención de un privado que se opone sin prueba para descalificar lo actuado por SETENA y SINAC. El Estado: indica que Apariencia de buen derecho: no existe seriedad en la demanda el solicitante, el nuevo proyecto cuenta con licencia de evaluación de impacto ambiental, otorgada por la SETENA, amparada en el artículo 46 BIS del decreto ejecutivo 31849-MINAE-S-MOPT-MAG-MEIC, que permite que las modificaciones de un proyecto ya evaluado sean aprobados sin necesidad de que la Comisión Plenaria de la SETENA vuelva a conocer todo el proyecto nuevamente.

En la modificación del proyecto se consideraron las nuevas circunstancias ambientales y los nuevos oficios del SINAC e informes que se presentaron con posterioridad, referentes a la presencia de ecosistema de bosque, por ello, SETENA resolvió suspender el inicio de la fase constructiva en resolución 1451-2020 de las 9:45 horas del 19 de agosto del 2020 y requerir una modificación al proyecto. En relación con la gestión de nulidad absoluta, evidente y manifiesta presentada debe indicarse que fue resuelta en resolución 0530-2023-SETENA de las 13:55 horas del 29 de marzo del 2023 y dispuso rechazar el incidente de nulidad en contra de la resolución 1739-2017-SETENA y de los oficios SETENA-DT-ASA-0349-2022 y SETENA-DT-ASA-1470-2022; se recalca SETENA no ha avalado ninguna construcción en áreas de bosque, como se menciona en la resolución 0530-2023-SETENA de las 13:55 horas del 29 de marzo del 2023.

Primera ampliación: aduce que los principios precautorio y preventivo se materializan durante el procedimiento de evaluación de impacto ambiental que se tramita ante SETENA, en el cual se admiten y analizan una serie de estudios para determinar, con base en la ciencia y la legalidad, si un proyecto determinado es o no ambientalmente factible, en aplicación del artículo 50 de la Constitución Política y el artículo 17 de la Ley Orgánica del Ambiente. Y en adición a lo indicado en el escrito anterior, sostiene que el terreno donde se realizará el proyecto y el mismo proyecto fue revisado por el SINAC que, ante consultas de la SETENA sobre posibles áreas de bosque, emitió el oficio SINAC-ACOPAC-OSREO-614-2019 del 12 de noviembre del 2019. No puede entenderse que en todo el terreno en donde se ubica el proyecto exista bosque, como lo pretende hacer ver el solicitante, de forma tal que deba impedirse, a priori, cualquier solicitud de permiso de corta.

La solicitud de medida cautelar resulta temeraria y carente de seriedad porque utiliza información desactualizada y descontextualizada en relación con el terreno y el proyecto analizado por la SETENA y el SINAC; el SINAC tiene la potestad legal de otorgar un permiso de corta de árboles o no, en terrenos de bosque o sin bosque, de conformidad con los artículos 19 y 27 de la Ley Forestal y los artículos 36 y 89 del Reglamento a la Ley Forestal, la ley no prohíbe de forma expresa la corta de árboles en terrenos de bosque y sin bosque, mientras se cumplan con los requisitos y sea aprobado por el SINAC, bajo un análisis técnico y científico. Peligro en la demora: manifiesta que el solicitante afirma que existe un grave daño efectivo e individualizable porque el proyecto no cuenta con licencia constructiva pero el proyecto en cuestión sí cuenta con permiso de construcción. El proyecto “Vistas Islas” fue evaluado ambientalmente por SETENA en expediente administrativo D1-19369-2017 y obtuvo la viabilidad ambiental en resolución 1739-2017-SETENA y en resolución 1451-2020 de las 9:45 horas del 19 de agosto del 2020, se ordenó la suspensión del inicio de las obras en virtud de una serie de cambios considerables en las condiciones ambientales del proyecto, hasta tanto no se realizasen las modificaciones en resguardo del ambiente con ocasión de los diversos informes posteriores a la evaluación de impacto ambiental que se incorporaron al expediente administrativo.

En virtud de ello, en oficio SETENA-DT-ASA-0349-2022 del 1 de febrero del 2022 se aprobó la modificación del proyecto “Vistas Islas” y posteriormente, modificada por oficio SETENA-DT-ASA-1470-2022 del 8 de agosto del 2022, ambos del Departamento de Auditoría y Seguimiento Ambiental, conforme al artículo 46 BIS del Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), decreto ejecutivo 31849-MINAE—SMOPT-MAG-MEIC. En consecuencia -en su criterio-, no existen daños graves actuales ni potenciales en virtud de la ausencia de licencia constructiva y de viabilidad ambiental como erróneamente lo pretende hacer ver el solicitante y tampoco han sido demostrados. Primera ampliación: señala que el actor no presenta prueba alguna que permita establecer el daño que invoca. Además, la suspensión del otorgamiento de permisos de corta de árboles carece de instrumentalidad y correlación respecto de los daños que invoca por erosión, porque la remoción de pendientes o movimientos de tierra no tiene relación con el otorgamiento de un permiso de corta de árboles por parte del Sistema Nacional de Áreas de Conservación (SINAC).

El proyecto obtuvo una licencia ambiental de SETENA y le permite realizar obras bajo la responsabilidad y riguroso cumplimiento de compromisos ambientales del desarrollador, con el fin de evitar daños a los suelos por erosión, a la biodiversidad y al recurso forestal. Reitera que se ordenó la modificación del proyecto original para evitar afectación, en virtud de nueva documentación del expediente administrativo. El Sistema Nacional de Áreas de Conservación (SINAC) se recibió una solicitud de autorización de corta y/o aprovechamiento de 23 árboles, en áreas sin bosque, el 17 de mayo del 2022. Esta solicitud denegada por resolución SINAC-ACOPAC-OSRAP-RES-021-2023 (ver el oficio SINAC-SE-DE-1536-023 del 06 de noviembre del 2023). Así, la Administración ha actuado en defensa del ambiente y del desarrollo sostenible, por lo que no existe un daño o riesgo de daño al ecosistema de bosque como lo pretende hacer ver el solicitante, que amerite el otorgamiento de la medida cautelar que ordene la suspensión de todo permiso de corta de árboles en la propiedad correspondiente al plano de catastro P-501725-1998.

Intereses en juego: indica que la Administración ha actuado conforme los principios precautorios y de desarrollo sostenible, reevaluando el proyecto inicialmente aprobado, en virtud de las nuevas circunstancias ambientales presentadas dentro del expediente administrativo. Actuación que también contempla los principios de seguridad jurídica y de legalidad que imperan en un Estado de Derecho. En virtud de lo anterior, en la vía judicial debe seguir imperando la defensa del interés público sobre cualquier interés privado que pueda tener el requirente. Apunta que existe falta de legitimación puesto que el otorgamiento de permisos de construcción es competencia propia de cada municipalidad. Primera ampliación: afirma que la Administración ha actuado conforme con los principios precautorios, de desarrollo sostenible y de legalidad. Debe prevalecer el interés público debidamente resguardado por el ordenamiento jurídico nacional sobre el requerimiento cautelar carente de prueba en cuanto a los daños y perjuicios que se invocan.

Segunda ampliación: señala que el acta 44 del 10 de diciembre del 2023 que aporta el solicitante demuestra que el SINAC dictó una orden de paralización de las actividades que se desarrollaban dentro del inmueble objeto de la presente litis. Por ende, la solicitud de que se ordene al SINAC y al Estado ejecutar la paralización de obras y actividades asociadas al proyecto Condominio Residencial Vista Islas carece de interés, porque la Administración ya ordenó la paralización de actividades en dicho inmueble. Mediante el oficio SETENA-DT-ASA-0349-2022 del 21 de febrero del 2022 de la Secretaría Técnica Nacional Ambiental, se le hizo ver al desarrollador que el cumplimiento de la Evaluación de Impacto Ambiental no lo exime del trámite a cumplir con otras autoridades de la Administración. En este sentido, corresponde al desarrollador referirse y demostrar que la remoción de árboles en el terreno y los movimientos de tierra constatados en el acta de inspección cuentan con los permisos correspondientes.

SINAC: Apariencia de buen derecho: sostiene, existe un expediente de solicitud para la autorización de corta y/o aprovechamiento de 23 árboles del Área de Conservación Pacífico Central (SUBREGIÓN AGUIRRE – en adelante ACOPAP) con el número de expediente PCPC03-IF-00035-2022, en el que el día 19 de abril de 2023 por resolución N° SINAC-ACOPAC-OSRAP-RES-021-2023, se deniega la corta y aprovechamiento de 23 árboles en la propiedad inscrita en el Registro Nacional con la matrícula número 6-109617-000 y el día 17 de octubre del 2023 se presenta solicitud de desistimiento de recurso de apelación presentada contra la resolución indicada por parte Vista Paradise MA SRL. El señor Brenes, no es destinatario de los supuestos efectos lesivos, daño efectivo o individual según lo alega en el apartado de admisibilidad subjetiva. De la medida cautelar no se desprende un juicio hipotético que permita al juez evaluar si la pretensión del actor puede o no tener posibilidades de éxito y que se tenga por cumplido este presupuesto, máxime cuando no existe un claro objeto procesal.

Ampliación: Indica que es de conocimiento de la Administración que existe un expediente PC-03-DJ-030-23, en el cual se está llevando un trabajo en conjunto con la Fiscalía Ambiental de Osa. En el oficio SINAC-ACOPAC-OSRAP-RF-128-2023 del 30 de noviembre de 2023 se indicó a la fiscalía: "...obtuvieron varios resultados, debido a los hechos se realizaron las órdenes administrativas: SINAC-ACOPAC-OSRAP-OA-013-2023, SINAC-ACOPAC-OSRAPOA-014-2023, SINAC-ACOPAC-OSRAP-OA-015-2023, SINAC-ACOPAC-OSRAP-OA-016-2023 en las cuales se solicita abstenerse a realizar la corta o la eliminación de la vegetación, transportar restos de vegetación o cualquier otra actividad de corta y transporte, se le impone la obligación de custodiar los bienes decomisados inmediatamente en el acta SINAC- ACOPAC-OSRAP-AD-005-2023 mientras el juez dispone del depósito provisional de los equipos, y el acta de decomiso SINAC- ACOPAC-OSRAP-AD-005-2023.

Siendo las mismas de cumplimiento inmediato a partir de la notificación”. El 10 de diciembre del 2023 mediante inspección realizada en conjunto con OIJ se crea el informe SINAC-ACOPAC-PNMA-RBS-111-2023 en atención de incidente reportado por movimiento de tierra y afectación a los recursos naturales Islas of Manuel Antonio, dirigido a la Fiscal Auxiliar Fiscalía Ambiental-Poder Judicial. Del cual se deprende el acta N°44 donde se indica lo antes mencionado y la paralización de las obras de manera inmediata y sacar la maquinaria del lugar. En vista de lo anterior el expediente se encuentra en una fase recursiva y hasta la fecha no se ha dado fin a la vía administrativa, por cuando existen dos recursos de apelación pendientes a resolver, los cuales una vez resueltos agotarían la vía administrativa. Aduce que si bien es cierto el recurrente tiene la razón en el principio de ambiente sano y equilibrado, el SINAC ha tomado todas las medidas respectivas estableciendo el compromiso ambiental para la protección del medio ambiente.

La prueba ofrecida por la parte actora, la actuación de esta Administración está fundamentada en su orden administrativa no obstante sólo adjunta como prueba una de ellas, sin tener conocimiento del trabajo en conjunto con la Fiscalía Ambiental de Osa que se está ejecutando. El actuar del SINAC, es en protección del medio ambiente, si hay alguien que afecta el ambiente como según lo indica el actor es al cual se debe denunciar. No existe actuación por parte del Sistema Nacional de Áreas de Conservación de otorgamiento de permiso. Por lo que no existe conducta de acción u omisión que se pueda achacársele. Peligro en la demora: sostiene que la parte actora no indica cuáles son, ni presenta ninguna prueba de dichos daños y perjuicios. Y aun tratándose de daños potenciales y no actuales, el análisis de la potencialidad del daño grave requiere que se establezca una cadena causal, al menos de forma argumentativa, que permita verificar el vínculo entre la actuación administrativa que se pretende y el daño que se alega dicha actividad pueda causar, lo cual se extraña en el escrito de interposición.

De la ampliación: sostiene que la parte actora no presenta ninguna prueba de dichos daños y perjuicios como la realización de obras de construcción en un área “que ha experimentado un cambio de uso del suelo”, estando presente ante un supuesto. Tratándose de daños potenciales y no actuales, el análisis de la potencialidad del daño grave requiere que se establezca una cadena causal, al menos de forma argumentativa, que permita verificar el vínculo entre la actuación administrativa que se pretende y el daño que se alega dicha actividad pueda causar, lo cual se extraña en el escrito de interposición. Ponderación de los intereses en juego: señala, no observa los elementos esenciales para que se dicte una medida cautelar, pues la ponderación de intereses público, no son claras y no se establece cuál es el interés legítimo, así como se detalla la falta de legitimación activa por parte de la parte autora para interponer el presente proceso como se establece en el artículo 9 de código procesal contencioso, como constan en la prueba documental ofrecida por el actor, no disponen ninguna actuación de esta Administración en contra del señor Brenes, por lo tanto él no es destinatario de los supuestos efectos lesivos.

Instrumentalidad señala que el actor carece le legitimación activa conforme al artículo 9 del CPCA. De la ampliación: aduce, como lo indica el autor “no existe ningún interés público afectado” basando en el supuesto de “estaría protegiendo el recurso forestal, resguardando bajo el principio de un ambiente sano y ecológicamente equilibrado”, cosa que el SINAC está efectuando, no existe ningún permiso otorgado su parte para cambio de uso de suelo, adicionalmente el actor no se establece cuál es el interés legítimo, así como se detalla la falta de legitimación activa por parte de la parte autora para interponer el presente proceso como se establece en el artículo 9 de código procesal contencioso, como constan en la prueba documental ofrecida por el actor, no disponen ninguna actuación de esta Administración en contra del señor Brenes, por lo tanto él no es destinatario de los supuestos efectos lesivos.

Insiste en la falta de legitimación activa conforme al artículo 9 del CPCA. Vista Paradise MA SRL S.R.L: Señala que no hay relación directa entre lo pretendido y el objeto de la medida cautelar, la que debe ayudar a preservar ciertas condiciones para luego decretar la nulidad de actos o resoluciones y cae en el error de intentar crear la idea de suspender la construcción del proyecto porque no cuenta con el permiso de construcción que sí tiene. En cuanto los presupuestos de la medida cautelar: Apariencia de buen derecho: la pretensión no guarda relación con lo instrumental, su dicho con apariencia de mala fe presupone que no hay permiso de construcción por lo que debe suspenderse el proyecto. Peligro en la demora: indica que estamos ante un mero dicho de una falsa apreciación, no hay permiso de construcción error y adjunta el permiso. Ponderación de los intereses en juego: sostiene que al contarse con el permiso de construcción se ha cumplido con el trámite, lográndose el desarrollo en armonía con el interés público y protección ambiental, goza de aval de SETENA.

Se refiere a la falta de legitimación del actor, debe comprobar la situación jurídica lesionada y un tema ambiental no es por sí mismo un tema difuso del cual cualquiera pueda hacer reclamo. Primera ampliación: refiere que todas las manifestaciones y alegatos del actor no son de discusión de un proceso solicitud de medida cautelar. Dicha discusión es reserva de conocimiento de fondo en otros tipo de procesos. Solicita rechazar la solicitud infundada y malintencionada y condenar en costas al actor. Segunda ampliación: afirma que en diversos escritos han aportado prueba sobre la legalidad de sus actos: oficio SINAC-ACT-OSRN-780-2023 – de la Autoridad Forestal del Estado indicando que el polígono en donde se construye el proyecto NO es bosque; permiso de Construcción de la Municipalidad de Quepos; viabilidad ambiental vigente para el proyecto emitida por la SETENA, respuestas de la Procuraduría General de la República y del MINAE solicitando el rechazo de la medida cautelar.

Producto de una denuncia anónima, el 10 de diciembre pasado, el SINAC y OIJ bajo la orden el fiscal de Osa, Camilo Flores, se presentan a la propiedad y realizan una inspección del sitio. El día de la inspección y posteriormente en el expediente de la fiscalía de Osa, presentamos la prueba pertinente que nos facultaba proceder a iniciar con el proyecto, lo cual está siendo analizado por la Fiscalía para determinar su proceder con respecto a la denuncia. Si el proyecto cuenta con todos los permisos que la ley exige para desarrollarlo, el seguir presentando denuncias anónimas y continuando presentando alegatos ante este Tribunal, es un acto simple de obstrucción y mezquindad. El proyecto llevará a la zona cientos de trabajos tanto en su fase constructiva, como eventualmente operativa y millones de dólares en inversión directa, todo lo cual es de beneficio para una zona tan necesitada. Es reiterativo que el promovente continúe insistiendo en el tema de que se trata de un bosque cuando, demostramos con prueba aportada al expediente, no es el caso.

Por ello, no existe ningún peligro de daño grave como lo pretende el promovente con la simple mención de artículos aislados tratando de dar sustento a sus argumentos, pero sin la presentación de NINGUNA prueba que sustente su dicho y que refute la nuestra. Ponderación de los intereses en juego, aduce que la Procuraduría hizo una basta explicación sobre el tema del interés público y los intereses tutelados, rechazando totalmente la tesis del promovente. Estamos frente a un caso de mala fe procesal, solicita rechazar la medida cautelar.-

V. EN GENERAL SOBRE LOS PRESUPUESTOS NECESARIOS PARA EL OTORGAMIENTO DE UNA MEDIDA CAUTELAR

La jurisprudencia ha desarrollado ampliamente el objeto de la justicia cautelar, la cual responde a la necesidad de garantizar el principio constitucional de una justicia pronta y cumplida, al conservar las condiciones reales indispensables para la emisión y ejecución de la sentencia. En este mismo sentido, el artículo 19 del Código Procesal Contencioso Administrativo, establece que el fin de la fijación de una medida cautelar es proteger y garantizar, provisionalmente el objeto del proceso y la efectividad de la sentencia. Partiendo de lo anterior, la persona juzgadora con observancia de lo dispuesto en el artículo 21 de la norma procesal indicada, debe determinar la procedencia de una solicitud de medida cautelar, verificando al efecto que la pretensión del proceso de conocimiento no sea temeraria o en forma palmaria, carente de seriedad, lo que constituye una valoración preliminar del fondo para determinar si existe en el caso en cuestión lo que la doctrina y la jurisprudencia han llamado apariencia de buen derecho o fumus boni iuris.

La norma de análisis también establece la procedencia de la medida cautelar cuando la ejecución o permanencia de la conducta sometida a proceso produzca graves daños o perjuicios, actuales o potenciales, situación que ha sido definida en la doctrina como el periculum en mora o peligro en la demora, es decir que, en virtud de la demora patológica del proceso judicial, concurra un peligro actual, real y objetivo de que se genere a la parte promovente un daño grave. Bajo la misma línea de pensamiento, el artículo 22 del Código Procesal Contencioso Administrativo, establece la obligación de la persona juzgadora de realizar a la luz del principio de proporcionalidad, una ponderación de los intereses en juego entre la circunstancia del particular, por un lado y por el otro, el interés público, así como los intereses de terceros que puedan verse afectados con la adopción de la medida cautelar.-

VI. SOBRE EL CASO CONCRETO

  • a)Sobre la legitimación activa. Parte de los argumentos esgrimidos es que existe falta de legitimación activa del Lic. Wálter Brenes Soto en este asunto en apego al artículo 9 del Código Procesal Contencioso Administrativo, puesto que no existe alguna actuación en su contra y no es el destinatario de los efectos lesivos. Al respecto debe indicarse que el numeral 105 de la Ley de Biodiversidad dispone: "Acción popular Toda persona estará legitimada para accionar en sede administrativa o jurisdiccional, en defensa y protección de la biodiversidad", de manera que resulta claro por esta ley especial, que el presente asunto puede se interpuesto por toda persona al constituir una acción popular, observando el objeto de la dicha ley, en su artículo 1: "El objeto de la presente ley es conservar la biodiversidad y el uso sostenible de los recursos, así como distribuir en forma justa los beneficios y costos derivados". b) Sobre las pretensiones de la medida cautelar incluidas en la gestión inicial y la primera ampliación del 10 de octubre de 2023: A efectos de resolver lo qe corresponda con relación a la medida cautelar promovida, estima esta juzgadora realizar un análisis diferenciado de las primeras pretensiones de la medida cautelar incluida en la gestión inicial y en la ampliación referidas a: "Se ordene de inmediato a la MUNICIPALIDAD DE QUEPOS la suspensión inmediata de cualquieras (sic) obras constructivas que se están ejecutando en la propiedad de VISTA PARADISE MA S.R.L, finca de Puntarenas, matrícula folio real número 109617-000, hasta tanto se demuestre se cuente con permiso constructivo, o se proceda a disponer lo contrario, mediante sentencia final y firme, que sea emitida por la misma jurisdicción contencioso - administrativa" y "Se le ordene al SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN la suspensión inmediata del otorgamiento de cualquier permiso de corta de árboles, en la propiedad con plano catastro P-501725-1998, ubicada en Puntarenas, Quepos, Manuel Antonio, lo anterior por encontrarse este Proyecto en una zona considerada como bosque, la cual tiene un impacto de alta fragilidad ambiental (conforme a los informes emitidos por el SINAC), esta medida cautelar debe mantenerse hasta tanto se emita sentencia firme y definitiva en este proceso de conocimiento".

Esto por cuanto se acredita de los autos que la empresa VISTA PARADISE MA SRL S.R.L., efectivamente cuenta con permiso de construcción PC 249-2017 otorgado por la Municipalidad de Quepos (ver imágenes 103, 192, 533, 564, 716, 747 del expediente judicial) aspecto que se pretendía, por ende, carece de interés la medida cautelar en cuanto esta pretensión. Respecto a la pretensión de la primera ampliación de la medida cautelar, se desprende de la prueba que el SINAC tramitó una autorización de corta y/o aprovechamiento de 23 árboles en el expediente PCPC03-IF-00035-2022 y que mediante resolución SINAC-ACOPAC-OSRAP-RES-021-2023 (ver imágenes 316 a 330 del expediente cautelar), se denegó esa corta y aprovechamiento de árboles en la propiedad matrícula número 6-109617-000 y posteriormente, el 27 de noviembre de 2023 se emite el acta de decomiso SINAC-ACOPAC-OSRAP-AD-005-2023 se apercibe de "abstenerse a realizar la corta y/o eliminación de la vegetación, transportar restos de vegetación o cualquier otra actividad de corta y transporte, se impone la obligación de custodiar los bienes decomisados mediante acta ACOPAC-USRAP-AD-005-2023...", en igual sentido el Acta Orden Administrativa SINAC-ACOPAC-OSRAP-OA-014-2023 del 27 de noviembre de 2023, Acta Orden Administrativa SINAC-ACOPAC-OSRAP-OA-015-2023 del 27 de noviembre de 2023, Acta Orden Administrativa SINAC-ACOPAC-OSRAP-OA-016-2023 del 27 de noviembre de 2023, todas le ordenan abstenerse de realizar cualquier actividad de aprovechamiento, corta y/o eliminación de vegetación (imágenes 591 a 592, 593 a 594, 595 a 596, 597 a 598 del expediente); por ende, puede concluirse que no existe ninguna solicitud de permiso de corta de árboles en dicha propiedad que deba suspenderse, por el contrario se realizan gestiones en conjunto con la Fiscalía a efecto de determinar si existen irregularidades según el informe SINAC-ACOPAC-OSRAP-RF-128-2023 del 30 de noviembre del 2023, dirigido al Fiscal Ambiental de Osa Lic. Camilo Roberto Flores Pacheco (ver imágenes 582 a 589). c) Sobre la tercera pretensión (la segunda ampliación): En esta pretensión se solicita "Se ordene al SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN Y AL ESTADO ejecutar la la paralización de obras y de actividades asociadas al Proyecto Condominio Residencial Vista Islas, en la propiedad con plano catastro P-501725-1998, ubicada en Puntarenas, Quepos, Manuel Antonio, del Condominio los Altos, 2 kilómetros al sur y 250 metros al este, lo anterior por estar realizando actividades en una zona considerada como bosque, con un alto impacto de fragilidad ambiental (conforme a informes emitidos por el SINAC), debiendo la medida cautelar mantenerse hasta tanto se emita la sentencia firme y definitiva dentro de este proceso ordinario".

Respecto a ella, se procederá a realizar el estudio de los presupuestos de la medida cautelar, requeridos por los artículos 21 y 22 del Código Procesal Contencioso Administrativo, de acuerdo con los argumentos de las partes y los elementos de prueba aportados al expediente. 1. Apariencia de buen derecho, del análisis de la solicitud se observa de forma preliminar, que la teoría del caso expuesta se encuentra razonablemente motivada de manera que, sin entrar en un juicio de valor sobre el fondo -lo cual, no es propio de este proceso cautelar- se estima que la acción ejercida no es temeraria o carente de seriedad, es decir, se cumple con el elemento de apariencia de buen derecho, por cuanto resulta susceptible de ser conocido en un proceso de conocimiento y el estudio del fondo trasciende las potestades de la resolución cautelar. 2. Peligro en la demora, el gestionante refiere básicamente a daños ambientales por un proceso de eliminación y pérdida del bosque y vegetación para limpieza del terreno, en los sitios en que se ubica y el área donde se pretende realizar el movimiento de tierras para cambiar la pendiente tan pronunciada, se ocasionará una alta erosión del suelo y los sedimentos perjudicarán la quebrada, el humedal y el manglar, causando daños irreversibles dado que las medidas de mitigación no son suficientes para evitar o recobrar el ecosistema.

Impacto negativo sobre la fauna en la eliminación de bosque, de las poblaciones de animales silvestres presentes en el área porque afecta directamente su hábitat y las especies animales algunas en peligro de extinción o amenazadas. La realización de obras de construcción en un área que ha experimentado un cambio de uso del suelo, a pesar de la prohibición del artículo 19 de la Ley Forestal, que constituye una infracción seria a las disposiciones destinadas a preservar y gestionar adecuadamente los recursos forestales, donde incluso a pesar de existir orden de paralización de obras, siguen construyendo. La prohibición de cambiar el uso del suelo de una ley especial y establecer plantaciones forestales en terrenos cubiertos de bosque no solo es una medida necesaria para preservar la biodiversidad, los servicios ecosistémicos y mitigar el cambio climático, sino que también refleja un compromiso con la sostenibilidad a un largo plazo.

Sobre el particular, este Tribunal en observancia al ordenamiento jurídico y en tutela debida del ambiente; partiendo de lo dispuesto en el numeral 50 de la Constitución Política, que establece el derecho a un ambiente sano y ecológicamente equilibrado, se desprende la obligación del Estado a procurar su debida tutela. En este marco de dicha tutela existe en nuestro ordenamiento jurídico extensa legislación que tutela el ambiente, así como jurisprudencia Constitucional y antecedentes de este Tribunal al respecto; los cuales desarrollan principios como el in dubio pro natura, precautorio, preventivo, "quien contamina paga", reparación in natura, entre otros, todos de relevancia que deben ser ponderados por la persona juzgadora, en resguardo del medio ambiente. Respecto a la justicia cautelar, la fórmula de los daños o perjuicios graves, actuales o potenciales, como delimitación del presupuesto del peligro en la demora, varía en el contexto del ambiente, "...los citados presupuestos deben valorarse acorde al contenido de los principios que impregnan el derecho ambiental, lo contrario, podría llevar a vaciar ese derecho y a permitir, vía omisiva, daños al medio, en mengua de los derechos de las personas" (así en resolución de este Tribunal número 250-2010 de las ocho horas del veintinueve de enero del dos mil diez).

Es claro que toda conducta humana intrusiva ante la probable afectación al ambiente requieren tutela cautelar en virtud del principio precautorio, que prescinde de la acreditación científica de un daño, contemplado en el artículo 11 de la Ley de la Biodiversidad. Respecto a la inversión de la carga de la prueba, esta consiste en que el demandado es el llamado a ofrecer pruebas para desvirtuar el contenido de la pretensión, considerando que el Derecho Ambiental pretende la prevención, en lugar de la reparación del daño, el artículo 109 de la Ley de Biodiversidad dispone "La carga de la prueba, de la ausencia de contaminación, degradación o afectación no permitidas, corresponderá a quien solicite la aprobación, el permiso o acceso a la biodiversidad o a quien se le acuse de haber ocasionado daño ambiental", tómese en cuenta, que no es necesario mención expresa de la persona juzgadora al respecto, toda vez que se encuentra regulado en la ley.

De forma que se rompe el clásico esquema de "quién afirma prueba" y nos encontramos frente a la teoría de carga dinámica de la prueba, donde se traslada la carga de la prueba "...a quién, a raíz de su situación personal, se halla en mejores condiciones para acercar la probanza al proceso, sin que importe si es el actor o el demandado" (al respecto ver la sentencia 212-2008 de las 8:15 horas del 25 de marzo de 2008). Ahora bien, frente a situaciones sobre la eventual afectación al medio ambiente, "...el juzgador para tomar la decisión de conceder una medida precautoria en defensa del medio ambiente, bastaría con la certeza y actualidad de los riesgos, aunque no estén probadas lesiones actuales al ambiente o la salud, para que la tutela se haga efectiva" (ver González Ballar, Rafael y Peña Chacón, Mario: El Proceso Ambiental en Costa Rica, 1a. edición, San José, 2015, p.163), es decir, en el marco de un análisis lógico y razonado, adquiere relevancia la cobertura de la eventualidad del daño, siendo inviable aplicar un criterio de daño efectivo, que resultaría contraproducente, ya que al consumarse el daño el mismo puede ser irreversible o de imposible la reparación.-

VII.Si bien existe una amplitud como la descrita en materia ambiental, esta Juzgadora considera que debe existir una certeza y actualidad de los riesgos al ambiente -no la necesaria demostración de un daño efectivo- y como lo señaló este Tribunal en sentencia número 250-2010 de las ocho horas del veintinueve de enero del dos mil diez, "...no opera una total desvinculación de quien pretende una medida cautelar de efecto suspensivo, como en este caso, o de cualquier otra índole, con el deber de acreditar o al menos poner en evidencia de manera objetiva y fundada, cuales son los riesgos potenciales que una determinada acción puede llegar a producir en el bien que se pretende tutelar, así como de los demás presupuestos que el numeral 21 del Código Procesal Contencioso Administrativo fija para la procedencia de las cautelares. El deber de acreditar la concurrencia de estas condiciones impostergables no encuentra excepción en las medidas que se relacionen con el ambiente" (lo subrayado no es del original), obsérvese de los autos, que la parte gestionante ofrece evidencias del riesgo al ambiente, aporta vídeos en disco compacto, fotografías, un criterio técnico del proyecto Vista Islas en Quepos Manuel Antonio (ver imágenes 817 a 830) emitido por la Ing. Paola Hernández Rodríguez, Ingeniera Forestal, que concluye "El área del plano P-501725-1998, ubicado en Manuel Antonio de Quepos, donde se pretende realizar el proyecto Vista Islas de Manuel Antonio, corresponde a bosque, y ha sufrido cambio de uso (...) En la actualidad y no se detalla en este informe el lugar está totalmente desprovisto de vegetación...", adicionalmente y constituye prueba determinante para este asunto, el acta de decomiso SINAC-ACOPAC-OSRAP-AD-005-2023 que apercibe al desarrollador del proyecto de "abstenerse a realizar la corta y/o eliminación de la vegetación, transportar restos de vegetación o cualquier otra actividad de corta y transporte, se impone la obligación de custodiar los bienes decomisados mediante acta ACOPAC-USRAP-AD-005-2023..." y también, el Acta Orden Administrativa SINAC-ACOPAC-OSRAP-OA-014-2023, Acta Orden Administrativa SINAC-ACOPAC-OSRAP-OA-015-2023, Acta Orden Administrativa SINAC-ACOPAC-OSRAP-OA-016-2023 del 27 de noviembre de 2023, todos del 27 de noviembre de 2023, que ordenan abstenerse de realizar cualquier actividad de aprovechamiento, corta y/o eliminación de vegetación (imágenes 591 a 592, 593 a 594, 595 a 596, 597 a 598 del expediente) y el informe SINAC-ACOPAC-OSRAP-RF-128-2023 del 30 de noviembre del 2023, dirigido al Fiscal Ambiental de Osa Lic. Camilo Roberto Flores Pacheco (ver imágenes 582 a 589), que consta: "...Cuarto.

Que al momento de la inspección el señor Quirós Elizondo no contaba con un Certificado de Origen (CO) o un permiso de aprovechamiento por parte de la Administración Forestal del Estado (AFE). (...)Sexto. Dentro del inmueble se logra observar que se realizó el aprovechamiento de varios árboles, se procedió a georreferenciar los tocones encontrados y a verificar su posible especie. Los tocones encontrados se muestran en el mapa siguiente: (...) Séptimo. Que de acuerdo con los tocones encontrados en el recorrido realizado, se logra determinar con ayuda del programa Qgis 3.24 que la ubicación de estos coincide con la ubicación de los árboles solicitados en el Inventario Forestal tramitado mediante expediente administrativo PC-03-IF-009-2022 (SICAF: PC-PC03-IF-035-2022) como se observa en el mapa 2, en el cual fue denegado el aprovechamiento mediante resolución administrativa SINAC-ACOPAC-OSRAP-RES-031-2022 por encontrarse dentro de ecosistema de bosque, el mismo se encuentra en proceso de resolutoria de un Recurso de Apelación ante el Consejo Nacional de Áreas de Conservación (CONAC), además se encontraron los tocones de dos palmas.

Octavo. Al momento de la inspección no se logró encontrar el tocón del árbol marcado con el número 27 del inventario forestal presentado (ver mapa 2), ya que en este sector se encuentra actualmente la casetilla del guarda y junto a esta se está levantando una estructura metálica tipo mirador, construida con perling cuadrado con dimensiones de 2 metros de ancho y 10 metros de largo aproximadamente. Décimo. Que en el sitio se encontraba un Back Hoe marca Caterpillar placa EE40222 conducido por el señor Juan Carlos Fallas González cedula 6 0355 0398, realizando labores de movimiento de tierra y de los escombros producto de las actividades de aprovechamiento forestal (ramas y troncos) que se realizaron en el sitio. Undécimo. Que además se encontraba en el sitio una vagoneta marca Mack placa C137849 conducida por el señor Fabio Alberto Leandro Gatgens cedula 6 0275 0584, realizando el transporte de tierra, partes de ramas y troncos.

Duodécimo. Los árboles cortados fueron completamente troceados (picados) en el sitio y los residuos estaban siendo transportados a un botadero municipal en el sector de Paquita de Quepos, según lo indicado por el encargado del proyecto. (...) Decimoséptimo. Se realiza un recorrido por el inmueble y se observa que se ha realizado socola por toda el área de bosque, se procedió a recorrer y georreferenciar el área afectada y se determinó que en el sector noroeste se encuentra una pequeña área de socola de 280 m2 aproximadamente, también se observa esta práctica del sector noreste hacia el sur como se observa en el recorrido realizado (ver mapa 3), se calcula un área de socola de 12 000 m2 aproximadamente en este sector" (lo subrayado no corresponde al documento original) y el acta 44 del 10 de diciembre de 2023, aportada por el promovente de la medida cautelar que ordena paralizar las obras y sacar la maquinaria (ver imágenes 438 y 439).

En definitiva, al acusarse riesgo al ambiente o daños potenciales, es imperativo sopesar la carga probatoria al amparo de los principios: in dubio pro natura, precautorio y preventivo, para que la persona Juzgadora considere la probabilidad objetiva, el riesgo previsible y objetivamente ponderado, de que una acción u omisión puede llegar a producir, con o sin medición científica, una incidencia negativa en el ambiente y ha de justipreciar la tutela ambiental y no esperar a que el daño ocurra, pues en la mayoría de las ocasiones será imposible la reparación (señalado así en la sentencia de reiterada cita, de este Tribunal 250-2010 de las ocho horas del veintinueve de enero del dos mil diez). En cuanto a la carga de la prueba en estos procesos (artículo 109 de la Ley de Biodiversidad), este Juzgadora observa que la representación del Estado no ejerció su carga procesal sino que se limitó a señalar que con el acta 44 del 10 de diciembre de 2023 se demuestra que el SINAC ordenó la paralización de las actividades y considera que carece de interés la medida cautelar; por el contrario, estima esta Juzgadora, que el SINAC ha desarrollado una serie de acciones en procura de la protección al ambiente como se desprende de la prueba aportada y la sociedad Vista Paradise MA SRL S.R.L. tampoco ha demostrado en este expediente que no haya causado algún daño ambiental carga que igualmente, le competía.

Por ende, existen elementos de convicción suficientes que permiten apreciar la existencia de riesgos o amenazas en el ambiente y en ese tanto, se cumple con este presupuesto. 3. Ponderación de intereses, considera esta Juzgadora que existe una correlación del medio ambiente y la acción del hombre, por lo que, debe examinarse con detalle este último presupuesto por los intereses que intervienen. Del presente asunto y en línea con lo expuesto en cuanto al peligro en la demora, debe prevalecer el interés público materializado en el derecho al ambiente sano y ecológicamente equilibrado, el cual no incumbe a una persona o a un grupo sino que es un interés general frente al interés particular de la empresa desarrolladora del Proyecto Condominio Residencial Vista Islas, en el inmueble 6-109617-000, plano catastrado P-501725-1998 inmueble propiedad de Vista Paradise MA SRL S.R.L., por ende, se verifica el presupuesto.

En consecuencia, al concurrir la totalidad de los presupuestos legales necesarios debe acogerse la pretensión tercera de la medida cautelar solicitada. En cuanto al requerimiento del día hoy de solicitar la certificación de la resolución de las quince horas y treinta y siete minutos del quince de mayo del dos mil veinticuatro, tramitada en el expediente número 18-000027-0611-PE, se rechaza la gestión por innecesaria considerando la forma en que se resuelve. Se resuelve sin especial condena en costas.-

POR TANTO

Se declara PARCIALMENTE CON LUGAR la medida cautelar solicitada, se acoge únicamente en cuanto se ordena al SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN Y AL ESTADO (SETENA) a paralizar las obras y actividades asociadas al Proyecto Condominio Residencial Vista Islas, en la propiedad con plano catastro P-501725-1998, ubicada en Puntarenas, Quepos, Manuel Antonio, por considerarse que se están realizando actividades en una zona considerada como bosque, con un alto impacto y fragilidad ambiental y adicionalmente, se ordena rendir EN EL PLAZO MÁXIMO DE UN MES, un estudio a efecto de determinar el impacto ambiental causado en la zona de interés. En lo no expresamente concedido, se rechaza la gestión cautelar. En cuanto al requerimiento de solicitar la certificación de la resolución de las quince horas y treinta y siete minutos del quince de mayo del dos mil veinticuatro, tramitada en el expediente número 18-000027-0611-PE, se rechaza la gestión por innecesaria. Se resuelve sin especial condena en costas. Notifíquese.- Ana Katarina Apú Hidalgo. Jueza.- ???????????????
