SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At thirteen hours and fifty-three minutes on the eleventh day of July, two thousand twenty-four.- ORDINARY PROCEEDING brought by ANA ISABEL PRADO CHINCHILLA, of legal age, single, farmer, resident of Cartago, La Unión, San Rafael, identification card one - five hundred eighty-nine - five hundred thirty-six; against CARLOS RODOLFO MORA SOLANO, of legal age, married, farmer, resident of San José, Acosta, Cangrejal, identification card one - one thousand eighty - four hundred thirty-four; and ILVER ANTONIO PRADO MONGE, of legal age, single, farmer, resident of San José, Acosta, Cangrejal, identification card one - five hundred sixty-six - six hundred fifty-eight. Attorney Ricardo Salazar Hidalgo, identification card two - four hundred thirty-two - zero eighteen, Bar Association number twenty-one thousand one hundred, acts as special judicial attorney-in-fact (apoderado especial judicial) for the plaintiff; and attorney Carlos Manuel Monge Monge acts as counsel of record (abogado director) for the defendants. Heard before the Agrarian Court of the Second Judicial Circuit of San José, Goicoechea.

Judge Picado Vargas writes the opinion; and,

WHEREAS:

I.Claims: The plaintiff instituted this ordinary proceeding seeking a judgment declaring the following: “1. That Ms. Ana Isabel Prado Chinchilla be declared the sole and exclusive owner and possessor of the property recorded in the Real Property Registry in the San José Registration District, under Real Property Folio (Folio Real) registration number 548944-000. 2. That it be declared that no agricultural easement (servidumbre agrícola) or right-of-way easement (servidumbre de paso) exists over property bearing Real Property Folio registration N°: SJ- 548944-000, either benefiting or burdening it. 3. That any right of passage (derecho de paso) existing by mere tolerance over my client’s property be declared extinguished, and that the co-defendants, their relatives, laborers, or any other person seeking to enter on their behalf refrain from doing so hereafter, because the plaintiff hereby terminates such mere tolerance. This shall be under penalty of prosecution for the offense of disobedience of authority if they fail to comply with the order of the judicial authority. 4. That, should this complaint be opposed, the co-defendants be held jointly and severally liable for payment of both categories of costs in this action.” (see the virtual case file of the San José Agrarian Court, filing incorporated on 21/04/2021 04:10:52).

II.After being duly served, the defendants filed an answer denying the complaint brought against them. (See the virtual case file of the San José Agrarian Court, filing incorporated on 09/06/2021 02:47:08)

III.Judge Vanessa Fisher González, of the Agrarian Court of the Second Judicial Circuit of San José, Goicoechea, ruled in judgment 2023000033, issued at one hour and thirty-six minutes on the eighth day of February, two thousand twenty-three: “THEREFORE: In accordance with the foregoing and the cited legal provisions, the complaint filed by ANA ISABEL PRADO CHINCHILLA against CARLOS RODOLFO MORA SOLANO and ILVER ANTONIO PRADO MONGE, all whose particulars have been stated, is DISMISSED in its entirety. No special award of costs is entered (See the virtual case file of the San José Agrarian Court, trial-court judgment incorporated on 08/02/2023 01:36:39).

IV.The documentary evidence offered by the plaintiff in her appeal is admitted as evidence to aid adjudication (prueba para mejor resolver), pursuant to Article 52 of the Ley de Jurisdicción Agraria.-

V.The list of facts deemed proven is adopted because it is consistent with the evidentiary record (acervo probatorio). The following additional facts are deemed proven: 13.- On August 11, 1956, Claudio Fallas García sold property 139456 to Pedro Prado Segura (certified copy of the deed admitted as evidence to aid adjudication at image 10 of the appeal). 14.- On April 24, 1995, Roberto, Pedro, and José Angel Prado Segura, owners in equal shares of property 154579, sold that property to Azucena Prado Segura (registry entry at image 84). 15.- On that same day, Azucena Prado Segura sold property 154579 to Pedro Prado Segura, and it became property 177426 (registry entry at image 84). 16.- On April 24, 1976, Roberto Prado Segura subdivided and sold from his property 248899 a lot to his brother José Angel Prado Segura, thereby creating property 248901 (registry entry at image 75). 17.- On April 24, 1976, Pedro, Roberto, and José Angel Prado Segura, as owners in equal shares of property 248893, divided it into three lots, one of which, number 2, was awarded to José Angel Prado Segura, thereby creating property 248897 (registry entry at image 78).-

VI.Attorney Ricardo Salazar Hidalgo, acting as special judicial attorney-in-fact for Ana Isabel Prado Chinchilla, filed an appeal against that ruling, stating as follows: “GROUNDS OR CLAIMS OF ERROR: FIRST GROUND. ERRONEOUS ANALYTICAL OR INTELLECTUAL REASONING REGARDING AN ALLEGED AGREEMENT TO CREATE AN EASEMENT (SERVIDUMBRE). The court below erred in assessing and analyzing the evidence and in concluding that, although the alleged easement does not exist, it was in fact created through an alleged oral agreement between the original owners of the dominant and servient estates (fundos dominantes y sirvientes), who were the brothers José Ángel Prado Segura (deceased in enero del año 2006), father of co-defendant Iver Prado Monge, and Pedro Prado Segura (deceased in julio del año 2020), father of plaintiff Ana Isabel Prado Chinchilla. It is striking that the theory of the alleged Oral Agreement was neither developed nor proven by the defendant, which focused on alleging two circumstances:

  • 1)that the easement was indeed registered because it was depicted on the cadastral plan (plano catastrado) of the plaintiff’s property and appeared as one of the boundaries in the literal certification (certificación literal) of the plaintiff’s property; and
  • 2)that even if registration of the easement encumbrance (gravamen de servidumbre) were not recognized, acquisitive prescription (prescripción positiva) had already taken effect because it had been used for more than 50 years. Both theories advanced by the defendant were properly rejected by the court below. However, the judge erroneously develops the theory that a tacit agreement had been reached between the fathers and former owners of the estates belonging to the defendant and the plaintiff, based on alleged circumstantial evidence (indicios), such as: a) the immemorial use of the easement; b) the fact that the easement was depicted on the plan of the plaintiff’s property; and c) the fact that the registry certification (certificación registral) for the plaintiff’s property identifies the right-of-way easement (servidumbre de paso) as its eastern boundary. This can be established from the following express language used by the court below in the appealed judgment: Likewise, if the cadastral plan for the property that belonged to Pedro (now belonging to the plaintiff) is analyzed, it may be inferred that cadastral plan No. SJ-815296-2002 (image
  • 3)describes that road as an “easement,” which leads to the defendants’ property. That plan was prepared in 2002, when, according to the analysis in the preceding recitals (considerandos), the servient estate belonged to Pedro Prado and the dominant estate belonged to José Ángel Prado, such that the agreement may reasonably be deemed proven. Although a cadastral plan is not, by itself, sufficient to create an easement, the point here is that, pursuant to the principle of unity of evidence (principio de unidad de la prueba), if that document is assessed together with the conclusive possession exercised by the owners of the dominant estate, it may be inferred with reasonable clarity that the agreement had indeed been entered into. A cadastral plan is prepared by bringing the physical reality into conformity with the cadastral record. In addition, the registry certification for the plaintiff’s property (image 2) states that its eastern boundary adjoins a right-of-way easement and José Ángel Prado, which further supports the existence of that agreement. However, those three items of circumstantial evidence are not valid grounds for concluding that an oral agreement to create an easement did exist, since that agreement does not describe the easement’s length, width, or direction, or whether it was gratuitous or for consideration, for a definite or indefinite term, or voluntary or compulsory. The First Chamber of the Supreme Court of Justice, in Voto N° 002395-F-S1-2020 de las diez horas veinticinco minutos del ocho de octubre de dos mil veinte, stated as follows: “V. The appeal in cassation (recurso de casación) filed does not achieve its intended effect and, to the contrary, constitutes a measure that proves futile for the purpose of overturning the first- and second-instance judgments. This is because the party never challenged the conclusion reached by the adjudicators that the evidence submitted—which the party claims was improperly assessed—is not suitable for proving the existence of the right-of-way easement, not in the sense of its physical existence, but rather that a restriction was established in the registry against the defendant’s estate for the benefit of the plaintiffs’ estates; since the suitable evidence for that purpose is none other than evidence demonstrating the creation of the easement in accordance with sections 370, 375, and 379 of the Civil Code. That evidence is absent throughout the entire proceeding, and for this reason it is not possible to order restoration of the easement as requested, because there is no agreement or testamentary disposition (disposición de última voluntad) stating its dimensions, nature, and other details. As the first-instance judge correctly explained and the appellate judges reaffirmed, a right-of-way easement cannot be created through the assent or mere use and tolerance of the owner of the servient estate, because this type of easement does not satisfy the characteristics imposed by the aforementioned section 379 of the Civil Code—namely, that it be both a continuous and apparent easement (servidumbre continua y aparente)—because it lacks the first requirement, as human activity is required each time it is used. With respect to the documentary evidence (prueba documental) submitted before this instance, it is inadmissible; first, because it was not submitted in the manner prescribed by section 609 of the Code of Civil Procedure (Ley 7130 being used to decide this appeal, pursuant to Transitorio I of Ley 9342, and the procedure being harmonized with the new legislation insofar as possible); and second, because the documents are not of material influence on the proceeding, since, like the evidence alleged to have been improperly assessed, they are documents indicating that the easement constitutes a boundary of the property, but not that such an easement was created.” (boldface and underlining not in the original). Section 375 of the Civil Code, which that Voto mentions, provides that the extent of easements is determined by the instrument of title (título), a necessary document that the defendant lacks for purposes of proving that agreement and supporting the theory of the court below. Furthermore, the First Chamber of the Supreme Court of Justice, in Voto N°001583-F-S1-2019 de las once horas cuarenta y dos minutos del veinticuatro de julio de dos mil diecinueve, stated as follows: “V. In her first two lines of argument, as summarized in III Considerando, the appellant disputes the absence of proof of the easement because, according to her theory, the original severances (segregaciones) of her properties demonstrate it through the boundaries described in the severance of her property 98090. At the same time, she alleges error in the severances that gave rise to the respondents’ properties after 1998, because they make an easement against her property no. 90038, which does not actually exist, ‘appear.’ Regarding this last point, it should be recalled that the Court rejected the counterclaim (reconvención) because, among other reasons, it found that no easement had been created in the disputed area for the benefit of the defendants’ parcels; accordingly, that final point lacks any legal interest, as it entails no ruling for or against the claims of any of the litigating parties. As to the first issue, as the Court correctly states, creation of the real right of easement (derecho real de servidumbre), particularly easements of a discontinuous nature—as is the case with a right-of-way easement—requires an agreement between the parties or a testamentary disposition (section 379 of the Civil Code). The plaintiff insists on proving the existence of the easement (in the disputed area) based on the description of the boundaries of the successive parcels derived from properties 20900 and 76048. That effort is insufficient, because a surveyor’s description of the boundaries of a property—reproduced by the notary for the corresponding registration of the land based on the information provided by the land surveyor—does not constitute the creation of any real right concerning those boundaries, their status, or their legal classification. Proof was required of a legal transaction (negocio jurídico) or testamentary disposition—it bears repeating—through which the plaintiff or prior owners of properties 90038-000 and 98090-000 established that real right for the benefit of the latter property. This demonstrates the impossibility of granting her claim of title to the easement and her denial thereof with respect to the defendants’ estates because, as reiterated, no easement is registered in the disputed area, either in favor of the plaintiff or in favor of the respondents. Her first two lines of argument must therefore be denied. (boldface and underlining not in the original). Those of us who have processed cadastral plans in recent years know that any land surveyor who becomes aware that an internal road provides access to another property located behind it will depict it as a right-of-way easement or agricultural easement (servidumbre agrícola), and will depict it as 7 meters wide even if it is not physically that wide. I state this from personal knowledge, based both on my own experience and on judicial cases with which I have been involved, in which estate owners have informed me that, despite pleading with or insisting that the surveyors depict the road as an internal road, the surveyors insist on depicting it as an agricultural easement or right-of-way easement. SECOND GROUND: ERROR IN THE ANALYSIS AND/OR APPLICATION OF SUBSTANTIVE LAW (LEGISLACIÓN SUSTANTIVA): The court below erroneously analyzes and applies section 1008 of the Civil Code, which provides: ‘The consent of the parties must be freely and clearly expressed. It may be expressed orally, in writing, or through conduct from which it must necessarily be inferred.’ The basis for the disagreement can be seen in the following express language used by the court below in the appealed judgment: ‘On this issue, the respondent is correct in arguing in its answer that section 1008 of the Civil Code must be applied in this case, which provides: “The consent of the parties must be freely and clearly expressed. It may be expressed orally, in writing, or through conduct from which it must necessarily be inferred”’ (emphasis not in the original). This is because proof of the agreement referred to in section 379 of that same body of law must be assessed in accordance with the circumstances of the case, particularly section 54 of the Law on Agrarian Jurisdiction (Ley de Jurisdicción Agraria). The plaintiff’s argument that no ‘written agreement’ was submitted is therefore untenable, because no formal proof system (sistema de prueba tasada) governs the proof of this circumstance. Under this interpretation, those statements show that there was clearly an agreement or intent on the part of the owner of the servient estate (Pedro Prado) that the road located on his property be used as an easement for his brother’s property (José Ángel), who even improved it more than twenty years ago.’ Regarding the statements made by the court below in the judgment, the plaintiff considers that the judge is incorrect for the following two reasons: 1) with respect to the creation of right-of-way easements, national case law has predominantly favored written rather than oral agreements as proof of their creation; and 2) section 1008 of the Civil Code itself begins by stating: ‘The consent of the parties must be freely and clearly expressed …,’ and the evidence submitted by the parties and the circumstantial evidence invoked by the court below do not clearly establish the information necessary to register an easement, such as its length, width, and direction, or whether it was for consideration or gratuitous, or for a definite or indefinite term.

The witnesses for the defendant party referred only to use by mere tolerance; they never stated that they had been present when the oral agreement establishing the easement (servidumbre) was made, setting forth a clear description of the constituent elements that are present in a genuine agreement. Although agreements may be oral, they must be conclusively proven, such as through statements by the former owners of the servient and dominant estates (fundos sirviente y dominante), statements by witnesses corroborating the legal transaction establishing the easement, and not merely the physical existence of a road and the analysis of indirect circumstantial evidence, which case law has already held to be insufficient to declare that a right-of-way easement (servidumbre de paso) has been established. In this regard, the First Chamber of the Supreme Court of Justice, in Judgment No. 000750-F-2000, issued at sixteen hours thirty minutes on the second of October of two thousand, stated as follows: “IV.

The co-defendant who is the appellant herein maintains that the easement was established by mutual agreement between the plaintiff and the former owner of the property. The plaintiff, for his part, while admitting that the electrical lines were installed with his consent, denies that the permission extended beyond a purely personal matter, that is, a gratuitous concession for the exclusive benefit of a relative. The establishment of an easement, as noted, entails an encumbrance in rem (gravamen real) on real property and, therefore, a very serious limitation on ownership. Accordingly, if it arises from an agreement, it must be based on a clear and express agreement. It cannot be inferred from acts or conduct of ambiguous meaning. According to the evidence analyzed by the adjudicators, primarily the testimonial evidence, there are sufficiently explicit and mutually consistent grounds to conclude that the repeatedly mentioned permission was granted intuitu personae.” (boldface and underlining are not in the original).

THIRD GROUND. PARTIAL TRANSCRIPTION AND TRUNCATION OF THE EVIDENCE. We note with dismay that extensive portions of the testimony of the defendant party (defendants and witnesses) are transcribed, while evidence from the plaintiff party that we consider important is truncated, such as the detailed description of the disturbances and the fact that the plaintiff’s mother, Mrs. Olga Chinchilla Arias, currently 85 years old (who is the oldest witness, not Mr. Noe Eduardo Elizondo Arias as stated in the judgment), lives in one of the houses adjacent to the alleged easement, as does her older brother, Dagoberto Prado Chinchilla, currently 62 years old, who has a heart condition; both were witnesses in the proceedings, but only portions of their testimony are mentioned, solely to support the position developed by the court below (A quo). I emphatically request that the Appellate Court listen to the audio recordings of the witnesses’ testimony and the plaintiff party’s examination as a party (declaración de parte).

For example, the testimony of the witness Dr. Cristina Prado was neither considered nor mentioned at all. Furthermore, the court below accepts as true everything stated by the witnesses for the defendant party. For example, the father of defendant Carlos Rodolfo Mora Solano, Mr. Aurelio Mora Cruz, maliciously stated, in order to favor his son, that the properties belonging to the brothers Pedro and José Ángel Prado Segura had been inherited from their father, which is false. For example, Mr. Pedro Prado Segura, father of plaintiff Ana Isabel Prado Chinchilla, acquired property bearing real-property folio (folio real) 139456-000 by purchasing it from Mr. Claudio Fallas García on 11 August 1956, before Notary Carlos Bolaños Morales; a certification thereof is submitted as evidence to assist the court in reaching its decision (prueba para mejor proveer). It should be noted that this property, real-property folio SJ-139456-000, measured 10 hectares, 26 ares, 88 centiares, 76 square decimeters, which disproves the statement made by the accommodating witness Aurelio Mora Cruz.

When Mr. Pedro Prado, father of plaintiff Ana Isabel Prado, purchased the property described above on 11 August 1956, Mr. Aurelio Mora Cruz, father of defendant Carlos Rodolfo Mora Solano, had not even been born, since Mr. Aurelio, currently 66 years old, was born on 13 November 1956 (according to the Civil Registry). The defendant party’s witness, Noe Eduardo Elizondo Arias, was only 10 years old in 1956 and was not even a nearby resident; he merely visited the hamlet of Cangrejal occasionally, as he states in his testimony. I request that the testimony given by the defendant party’s witnesses, Messrs. Aurelio Mora Cruz and Noe Eduardo Elizondo Arias, be regarded with doubt. FOURTH GROUND. OBJECTION TO THE FAILURE TO GIVE WEIGHT TO THE DISTURBANCE AND THE ASSERTION OF A RIGHT IN REM BY DEFENDANT CARLOS RODOLFO MORA SOLANO: In this case, the court below minimizes two important elements of an action to deny an asserted right in rem (acción negatoria): the disturbance and the defendants’ assertion of a right in rem (derecho real).

This can be seen in recital VII (considerando VII), where the Judge minimizes the disturbances caused by the defendants (motorcycle tours and cockfights), even though disturbance is one of the triggering elements of any action to deny an asserted right in rem, as is the fact that the defendants claim a right that has not been established, namely the right-of-way easement. Ulate states: “It is a means of defense against interference with or intrusion upon another person’s property, committed on the basis of claiming a right” (Ulate Chacón Enrique. Manual de Derecho Agrario y Justicia Agraria. San José, Calbasa; 2007, p.713). The fact that the Prado Chinchilla family allowed the Prado Monge family to pass through by mere tolerance for 50 years, because they were family, does not mean that a third party unrelated to the family may come and purchase a right and must be allowed to conduct activities such as motorcycle tours and cockfights, during which a throng of motor vehicles and people passes through the plaintiff’s property, where her elderly mother lives, as does her older brother, who has a heart condition, and who need peace and quiet in their lives.” (See the virtual desk of the Juzgado Agrario de San José, filing incorporated on 16/02/2023 05:37:19).-

VII.It is appropriate to set out, first, the elements comprising a negatory action (acción negatoria), which is the subject matter of the present case, as may be gathered from the summary of claims contained in the complaint appearing at folio 58. Said action falls within the broad range of remedies provided by our Legal System for the protection of property and was addressed in Voto of this Court issued at 14:45 on 17 de agosto de 1997, No. 586, which, citing the Sala Primera de Casación, stated, insofar as relevant: “...IV.- The case law of the Sala Primera de Casación has reiterated in many judgments the principles concerning the various actions protecting the right of ownership. Among others, judgment No. 230, issued at 16 hours on 20 de julio de 1990, stated: ‘IV.- Our legal system provides a broad range of remedies for the protection of property in its various manifestations. It may be noted that, although scattered throughout different parts of the Código Civil and even other bodies of law, there is an entire system of protective actions (artículos 295 y 316 del Código Civil), divided into two main categories: 1) Self-help actions (acciones de hecho), contemplated in artículos 305 y 306 del Código Civil, concerning the authorization granted to an owner to defend the owner’s right directly when it is threatened; in such a case, however, the action is legally protected only insofar as the protection is exercised in accordance with the particular requirements of self-defense (legítima defensa), that is, in response to unlawful aggression, where the defense is necessary and the means employed are proportionate. 2) There is also a complex set of legal actions (acciones de derecho), applied according to the circumstances, the owner’s needs, the right affected, and even the urgency with which they must be used.

These actions often have a similar formal structure (with regard to the owner, the person who affects, disturbs, or dispossesses the property, and, above all, the proper identification of the thing); nevertheless, they differ greatly in the manner in which they protect property. These actions may be divided as follows: A) ordinary actions (acciones ordinarias), including within this category: a) the action for recovery of ownership (acción reivindicatoria) (artículos 316, 320 a 333 del Código Civil); b) the negatory action, concerning interference with an attribute of ownership other than possession, known as the actio negatoria in Roman law; and c) the Publician action (acción publiciana), more commonly known in Costa Rica as the action to establish the superior right of possession (mejor derecho de posesión) (artículos 317 y 322 del Código Civil)... V.- ACTIONS FOR THE PROTECTION OF PROPERTY (AS A RIGHT IN REM) IN ORDINARY PROCEEDINGS: These actions parallel those protecting other rights in rem (derechos reales), such as possession, usufruct, and easement (servidumbre), which are given other names depending on the relief sought.

Specifically: 1. To recover possession, the holder of the right of ownership has an action for recovery of ownership, while a person holding the right of possession who has been dispossessed has the well-known “Publician action” or action to establish the superior right of possession; 2. Likewise, when an owner does not seek to recover possession but does seek a declaration of the owner’s right with erga omnes effect, the owner has a DECLARATORY ACTION OR ACTION FOR CERTAINTY (ACCIÓN DECLARATIVA O DE CERTEZA); 3. Similarly, the owner may deny a right in rem claimed by another person, through what is known as a NEGATORY ACTION (ACCIÓN NEGATORIA). It is logical to consider that these last two actions are also available with respect to the right of possession as a right in rem requiring protection. Thus, a possessor whose right of possession is disturbed—not possession as a mere fact, in which case an interdict action (acción interdictal) could be brought—may seek in ordinary proceedings a declaration that the right belongs to that possessor and may also deny another person a right that the latter is improperly claiming and that does not belong to that person (DECLARATORY AND NEGATORY ACTIONS [ACCIÓN DECLARATIVA Y NEGATORIA])...

VIII.- THE NEGATORY ACTION: The NEGATORY action is also an action in rem (acción real) that may be brought both by an owner and by a person who legitimately holds another right in rem. “The negatory action is available to an owner to obtain a declaration that the thing subject to the owner’s right is not encumbered by the right that another person claims over it. It is called a negatory action or an action to establish freedom of property and may be brought by any owner, whether or not in possession, whether a sole owner or co-owner, and with respect to both movable and immovable property... It is a means of defense against disturbance of or interference with another’s property, committed on the basis of a claimed right... The action is not expressly regulated by the Código Civil, but its exercise has been recognized and regulated by the case law of the Tribunal Supremo. Its fundamental requirements would be the following: 1.

Proof of the claimant’s current ownership. 2. Proof of the acts of disturbance caused by the defendant in the enjoyment or exercise of ownership. This disturbance must have been carried out under a claim to hold a right in rem over the thing, since possessory actions (acciones posesorias) may be used to restrain mere factual disturbances.... The negatory action fundamentally produces the following effects: on the one hand, a declaration that the right claimed by the defendant does not exist; and, on the other, compensation for damages and losses (daños y perjuicios), together with cessation of the disturbance.” (See MONTES, op. cit., páginas 106-108).- The negatory action has also been defined as follows: the action available to possessors of immovable property against those who prevent them from freely exercising their rights in rem, so that such freedom may be restored. (Artículo 2.800 del Código Civil Argentino).

This action lies against anyone who disturbs another’s right to possess, even the owner of the immovable property, when that person arrogates to himself or herself an improper easement over it... (See CABANELLAS, Guillermo. Diccionario de Derecho Usual, op, cit, Tomo I, página 48). In principle, and based on Roman sources, the negatory action was granted essentially to an owner who, upon being troubled or disturbed by a person claiming a right of usufruct or easement, sought a declaration that such right did not exist. Referring to those Roman sources, Spanish legal scholarship cites the following instances of the negatory action: “This is the action belonging to the owner of an estate against a person who claims to hold a usufruct over it when the owner denies the existence of that usufruct.” “This is the action available to the owner of an estate against a person who wrongfully claims a right of way through it.” “This is the action of the owner of an estate against a person who claims the right to erect a building on his or her own land beyond a certain height, when the claimant denies that such person has that right.” (MARTIN-BALLESTERO, Luis.

La acción negatoria, Editorial Tecnos, Madrid, 1993, p. 43). From that perspective, only the owner had standing to bring the negatory action. The party with standing to be sued could include not only those who sought to maintain a possible easement; the existence of a factual condition or situation objectively corresponding to the exercise of an easement or usufruct was sufficient. It was therefore a limited action. Traditional legal scholarship required the following elements for a negatory action: “1. That the claimant establish prima facie the claimant’s right of ownership (by presenting the corresponding instrument of acquisition of the thing). 2. That the claimant prove the disturbance caused by the defendant in the enjoyment of the claimant’s property (a disturbance that must be carried out under a claim to hold a right in rem, since it is unnecessary to resort to this action to restrain purely factual disturbances).

Conversely, the claimant need not prove the nonexistence of the easement or right in rem claimed by the third party, because it is a repeatedly stated principle of law that property is presumed to be free of encumbrances and that the person asserting the existence of limitations upon it bears the burden of proving them.” (CASTAN TOBEÑAS, Derecho Civil español, común y foral, ed. rev. por G. García Cantero, 2, vol. 1o., Reus, Madrid, 1992, p. 216, citado por Martin-Ballestero, op.cit., p. 80). IX.- In modern practice, the negatory action has a different character. It is not limited to protecting the right of ownership. It must be recognized that holders of other rights in rem over the thing are entitled to protection against those who exercise alleged rights over it that are detrimental to them. They unquestionably deserve protection from the legal system, regardless of whether it is called a negatory action or another type of action.

Spanish legal scholarship now recognizes that a negatory action may be brought not only against acts of disturbance arising from the alleged exercise of a right in rem consisting of an easement or usufruct, but also when the disturbance or nuisance is purely factual or when a person alleges having acquired, through a private instrument, a right that the holder now denies. In this case, it would constitute a purely declaratory negatory action...” (Emphasis not in the original).-

VIII.It is also appropriate to analyze the concept of an easement by destination of the owner (servidumbre de destino de padre de familia), asserted by the defendant and denied by the plaintiff throughout the proceedings. This is an easement (servidumbre) of statutory origin, concerning which Voto 113-F-09 of this Court, addressing easements, held: “V.- ...He seeks a judicial declaration of a right-of-way easement (servidumbre de paso) in his favor, without compensation, on the grounds that his property once formed a single parcel with the defendants’ land and that, since time immemorial, he has used the passage across those properties to reach the public road in Las Palmas. He further maintains that the creek behind his house, known as Quebrada Las Palmas, a tributary of Río Sucio, prevents passage or access to the public road adjoining his property to the north and west, which adversely affects him because his wife is ill.

He complains that the defendants blocked his passage, disregarding that existing right of way and leaving him with no practical means of comfortably leaving his property and without adequate access to the public road (folios 428 to 434). All of this leads us to consider the nature of a right-of-way easement and the various methods of its creation recognized by our legal system, which derives from French law. VI.- More than ten years ago, this Court explained in a decision the different ways of resolving a case such as this one, stating in that regard: ‘...One of the essential aspects of easements concerns their content and method of creation, and this issue is essential to deciding the merits of this matter. When a parcel becomes landlocked (fundo enclavado) and consequently has no access, or no adequate access, to a public road, the legal system provides several possible solutions, depending on the factual circumstances that caused it to become landlocked.

The first possible solution for a landlocked parcel is to provide adequate access to the road through the creation of a voluntary easement (servidumbre voluntaria). Regarding voluntary easements, Manuel Albaladejo states: “Easements are created: 1. By the will of the interested parties, through a legal transaction mortis causa or inter vivos (...) To create them, one must have the legal capacity to dispose, by the act in question, of the property upon which they are imposed, and the grantor must possess the powers corresponding to those conferred by the easement over the burdened property. It is therefore unquestionable that an easement may be created by the owner holding full title (or, if there are several owners, by all of them acting unanimously); as for a bare owner or an owner whose title is limited by some other right (such as a prior easement already existing over the property), that owner may create it insofar as it does not impair that other right, and a person who, though not the owner, holds a right over the property that confers the powers that the easement will grant to the owner of the dominant estate may also create it (subject to the same limitations noted above for an owner with limited title) for the duration of that person’s right.” This possibility of creating an easement by agreement, whether mortis causa or inter vivos, is governed by the Civil Code through Articles 378 and 379.

The former provides: “Easements that are both continuous and apparent may be created by agreement, by testamentary disposition, or merely through use by one party and acquiescence by the other,” while the latter article provides: “Discontinuous easements of every kind and continuous non-apparent easements may be created only by agreement or by testamentary disposition. Possession, even from time immemorial, is insufficient to establish them.” Another way of resolving the problem of a landlocked parcel is the situation contemplated in Article 380 of the Civil Code, which provides: “The existence of an apparent sign of a continuous easement between two parcels, established by the owner of both, is sufficient for the easement to continue, actively or passively, unless, when ownership of the two parcels is separated, the instrument conveying either of them expressly provides otherwise.” This concept is known as an easement by “destination of the owner” and “consists in the rule that, if there is an apparent sign of an easement between two properties established by the owner of both, the conveyance of one shall be deemed sufficient title for the easement to arise” (ALBALADEJO, Manuel.

Derecho Civil, Tomo III, Vol. II, Editorial Bosch, 8a. edición, 1994, pág. 141). Consequently, where an easement exists, the plaintiff clearly has the right to exercise the powers granted to him by law for its use. Indeed, Article 374 of the Civil Code provides: “A person entitled to an easement is likewise entitled to the means necessary to exercise it and may carry out all work indispensable for that purpose, but at that person’s own expense, unless otherwise stipulated....” An easement by destination of the owner must satisfy a series of requirements, which Albaladejo aptly explains by quoting Bonet Correa, as relevant here: “The easement is created ex lege (...) upon fulfillment of the requirements prescribed by law, irrespective of whether its signs were not removed through inadvertence or were maintained so that the easement would arise; the same applies where the deed contains no declaration opposing the easement.

The sign must be practicable (...) it is immaterial whether the easement created is necessary. (...) The law states that the apparent sign of the easement must have been ‘established by the owner of both’ (....) But the term ‘established’ should not be narrowly construed; thus, we understand that a sign placed by another person and maintained by the owner is also valid. What matters is that it exist when the property is conveyed. (...) The easement does not arise if, when ownership of the two properties is separated, the instrument conveying either of them expressly provides otherwise. (...) It follows that, if only one is conveyed, the contrary intention must be stated in the instrument conveying that property, and if both are conveyed simultaneously, it may be stated in the instrument conveying either of them. (...) ‘Instrument’ means the corresponding deed.” (ALBALADEJO, Manuel, Derecho Civil, Tomo III, Vol. II, Editorial Bosch, 8ª. edición, 1994, pág. 141-143).

It is clear that no compensation is payable in this situation because the easement already existed and had been used for those purposes since the parcel that theoretically became landlocked originated, although in reality it had access established by the former owner. It therefore follows that no compensation is due, since the access was acquired by operation of law, that is, ipso iure, without the need for a judicial declaration. The third possibility for providing access to a landlocked parcel is a compulsory easement (servidumbre forzosa). In this regard, Article 395 of the Civil Code provides: “The owner of a parcel landlocked among other properties, without access or adequate access to a public road, is entitled to demand passage across neighboring properties for the use of his own, upon payment of the value of the necessary land and compensation for any other damage.” Regarding this type of compulsory easement, Albaladejo states: “By order of the authority (judicial or administrative), that is, through an award decreed by that authority in favor of the holder.

This occurs in the case of compulsory appurtenant easements (servidumbres prediales forzosas) (...) when, after their creation is requested by the person entitled to them, they are granted by the competent authority” (ALBALADEJO, Manuel, Derecho Civil, tomo III, Vol. II, Editorial Bosch, 8a. edición, 1994, pág. 141-143). This method of creation is distinguished by the fact that the easement is created through a judicial declaration, and compensation must be paid for the value of the necessary land and any other damage. Finally, the problem of a landlocked parcel may be resolved through the legal institution of a right of passage (derecho de paso), governed by Article 400 of the Civil Code, which provides: “If any portion of a parcel is sold or exchanged, or if any portion is awarded to one of those who held it in common, and that portion becomes landlocked, a right of passage shall be deemed granted in its favor without any compensation.” This article is distinctive in that the parcel becomes landlocked as a result of an act of disposition by its owner, who transfers part of the property while leaving one of the portions landlocked.

Consequently, for reasons of social and economic interest requiring every parcel to have access to a road, it is understood that every parcel must have such access and that the person is entitled by operation of law to a right of passage so as to obtain access to the road, without being required to pay any compensation for it. In summary, the foregoing arguments establish four different solutions to the problem of a landlocked parcel....’ (Tribunal Agrario, No. 635 de las 13:45 horas del 24 de setiembre de 1999). VII.- Given the particular circumstances of the case before us, in which the alleged right-of-way easement claimed by the plaintiff may derive from a parcel that originally belonged to the same owner, it is appropriate to examine more closely the nature of an easement by destination of the owner in order to determine whether that legal institution applies only to continuous or apparent easements, as some legal scholarship maintains, or whether it may also apply to discontinuous easements, such as a right-of-way easement, when an apparent sign of an easement exists and the easement was not rejected when the transfer or deed was executed.

As to the origins of Article 380 of our Civil Code, reference must first be made to the French experience, where the legislature, legal scholarship, and case law have agreed on giving a broad scope to easements by destination of the owner, recognizing their application also to right-of-way easements where an apparent sign of an easement may exist. Articles 692, 693, and 694 of the French Civil Code provide: “692.- Destination of the owner constitutes title with respect to continuous and apparent easements.” “693.- Destination of the owner shall exist whenever it is proven that the two properties now divided belonged to the same owner and that it was through that owner that the properties were placed in the condition from which the easement results.” “694.- If the owner of two properties between which there is an apparent sign of an easement disposes of one of the properties without the contract containing any clause concerning the easement, it continues to exist actively or passively in favor of the conveyed parcel or over the conveyed parcel.” Regarding the division and assessment of the evidence, French case law has established the following criteria concerning the existence of an apparent sign: “In the absence of any provision in the instrument effecting the separation of the two properties, proof of a right-of-way easement established by destination of the owner arises from the existence of an apparent sign of an easement.” (Req. 6 déc. 1898, D.P. 99, I, 87.- Civ. 8 juill. 1919, D.P. 1923.1.230, en: Códe Civil, Dalloz, Paris, 1965, p. 311) “The trial judges have sovereign authority to determine whether, following the division of the properties effected by their common predecessor in title, there existed an apparent sign of an easement established by destination of the owner; and, where relevant, they may consider the grantor’s intent, the extrinsic circumstances, the manner in which the instruments or agreements were performed, and likewise matters arising after the division of the parcels” (Civ. 3e. 25 janv.

1972: Bull.civ.III, no. 54 23 janv. 1991: ibid. III, no 38.- Settled case law). In the absence of apparent signs on the plan attached to the deed of sale, those apparent signs must be sought in the physical condition of the place itself (Civ.3e, 11 juin 1992: bull.civ.III, no. 201). The apparent factual condition characteristic of an easement by destination of the owner (servidumbre por destino de padre de familia) must exist when the estates (fundos) are divided (Soc. 27 déc. 1945: D. 1946). Civil Code, 101º edition, Dalloz, 2002, page 650. French legal scholarship refers to a centuries-old controversy concerning the interpretation of both provisions (Bonecasse, Elementary Treatise on Civil Law, Harla, 1990, p. 498). Under Article 693, three constituent elements of the easement (servidumbre) are identified: “1. The two properties, now separate, must previously have belonged to the same owner; 2.

It must be shown that this owner created the current condition of the properties—that he created the factual condition from which the easement, which had never previously existed, later arose; and 3. This factual condition must be permanent and constitute an easement, rather than being merely an arrangement for convenience” (PLANIOL AND RIPERT, Civil Law, 1990, Harla, p. 546). Regarding the interpretation of Article 694, the cited authors state: “Art. 694 requires only an apparent sign of an easement. The easement need not be continuous. Can Art. 694 be applied to a right-of-way easement (servidumbre de paso), which cannot be created by destination of the owner because it is discontinuous?... In our opinion, the distinction should be as follows: Art. 692 concerns the creation of a new easement by destination of the owner that had never previously existed; it first arises in fact before becoming an easement when the two properties are separated.

Art. 694 concerns cases in which an easement, established by any means, already existed between two properties that subsequently came to belong to the same person. In that case, the easement was extinguished by merger (confusión), and the question is under what conditions it will revive when the two properties are separated again. It continues to exist, the text says, which is a very precise expression; it will be seen that merger creates no temporary impediment to the exercise of the easement and, in reality, does not extinguish it. The law requires only an apparent sign of an easement, that is, an indication of an intention to maintain the prior factual condition. The law makes it easier to preserve an easement than to create one and does not require continuity. This is how the tribune Albison explained Art. 694...” (PLANIOL and RIPERT, op. cit., p. 546). More recent French legal scholarship refers to this longstanding controversy concerning easements that are apparent but discontinuous, such as a right-of-way easement where a route has been laid out for its exercise, noting that this case law has been endorsed by most authors: “French case law adopts a solution more consistent with the literal meaning of Articles 692 and 694 and with the traditions of the customs of Paris and Orléans.

Its reasoning derives from the basis for creating an easement by destination of the owner, a creation grounded in the presumed intent of the parties who, following the act of separation, allowed the prior state of affairs to remain.” (TERRÉ, Francois and SIMLER, Philippe, Droit civil. Les biens, 5a. edition, Paris, Dalloz, 1998, p. 677). It follows from all the foregoing that an easement by destination of the owner applies, in principle, to apparent and continuous easements. However, when an owner establishes an apparent sign of an easement for the better conduct of the owner’s activities between two properties, or within a single property, and the property is subsequently divided into parts, the arrangement created for the convenience and utility of the owner’s own property remains in effect for the benefit of, or as a burden on, the properties resulting from the division. Accordingly, this legal doctrine (instituto) also applies to right-of-way easements.

To better understand the subject and reinforce this interpretive criterion, it is important to examine the regulation of this doctrine in other countries and the analysis offered by prevailing legal scholarship. The Spanish Civil Code incorporated the doctrine in Article 541: “The existence of an apparent sign of an easement between two properties, established by the owner of both, shall be deemed, if one is transferred, to constitute title for the easement to continue both as a benefit and as a burden, unless, when ownership of the two properties is separated, the instrument transferring either one states otherwise, or the sign is removed before execution of the deed.” In interpreting the scope of the provision, Spanish legal scholarship states: “The article in question applies to any easement, provided it is apparent; thus, it applies whether the easement is continuous or discontinuous (judgments of 10 octubre 1957, 22 noviembre 1963, 11 junio 1975 and 7 julio 1983)...

It is irrelevant whether the easement created under Art. 541 is necessary. Thus, it arises even if another easement already exists for the same purpose in favor of the dominant estate (predio dominante). For example, if there is an apparent sign of a right-of-way easement, that easement arises even if the benefited property already has another means of access to a public road, whether through another easement or because it has direct access to that road (judgments of 10 octubre 1957 and 26 enero 1971). ALBALADEJO, Manuel. Civil Law, Volume III, vol. II, 1994, p. 142). According to legal scholarship, the same criterion applies in the case of co-ownership (copropiedad), where an easement by destination of the owner may also be created: “If one or both properties are co-owned and the sign was established by all co-owners, or was established by one and preserved by the others, there is no difficulty, and the result is the same as where there is a single owner....

Where an act by one co-owner gives rise to an easement in favor of the commonly owned property, that is, benefits the co-ownership, it appears that the creation of the easement should be recognized...” (ALBALADEJO, Ibid.). The unified Italian Civil Code of 1942 also incorporated this doctrine for apparent easements in Article 1062 by allowing acquisition of an easement through “destinazione del padre di famiglia,” which takes into account the act by the sole owner of designating one property for the service of another, reflecting the intent to place or leave the properties in a condition from which the appearance of an easement results. It is therefore a mere legal act or fact (acto o hecho jurídico) of designation intended to endure unchanged until the properties are separated, at which point the easement arises unless there is a provision to the contrary. In the absence of such a provision, the easement is created “ipso iure” when the properties are separated, and any form of evidence, including witness testimony, is admissible to prove its existence (BUSNELLI et al. Diritto Civile, Diritti Reali, Utet, 1988, p. 262).

Consequently, French, Italian, and Spanish legislation, legal scholarship, and case law concur in recognizing that an easement by destination of the owner may be created when it originates from a single owner or from co-owners of the same property, involves a right-of-way easement, and displays apparent signs when the property is divided, regardless of whether the benefited property has another exit or means of access to a public street. VIII.-Other Latin American legal systems, including ours, have adopted and regulated easements by destination of the owner. By way of example only, the Colombian Civil Code provides in Article 938: “If the owner of a property establishes an apparent continuous service in favor of another property that also belongs to that owner, and subsequently transfers one of them, or they come to have different owners through partition (partición), the same service shall continue as an easement between the two properties, unless the instrument establishing the transfer or partition expressly provides otherwise.” The Bolivian Civil Code provided in Section 278: “When the owner of two properties between which an apparent sign of an easement exists transfers one of them without any provision concerning the easement, the easement shall be deemed established as a benefit or burden in favor of or against the transferred property.” The Venezuelan Civil Code is more explicit and clear, providing among the methods of creating easements in Article 721: “Destination of the owner applies only to apparent easements, whether continuous or discontinuous, and when it is established by any form of evidence that two properties currently divided were owned by the same owner and that the owner placed or left the properties in the condition from which the easement results...

If the two properties cease to belong to the same owner in any of the cases described in the two preceding paragraphs, without any provision concerning an easement, the easement shall be deemed established as a benefit or burden on each of those properties.” IX.- Our Civil Code provided as follows in Article 380: “The existence of an apparent sign of a continuous easement between two properties, established by the owner of both, is sufficient for the easement to continue as a benefit or burden, unless, when ownership of the properties is separated, the instrument transferring either of them states otherwise.” As in the French code, that provision appears after Articles 378 and 379 of the Code, which regulate the creation of continuous and apparent easements, as well as discontinuous and continuous non-apparent easements, as general rules. Consequently, the rule in Article 380 is an exception to the preceding rules.

The following requirements emerge from the literal wording of that provision: 1.- The existence of an apparent sign of an easement between two properties. 2.- That those properties belong to the same owner. 3.- That the apparent sign continue as a benefit or burden. 4.- That no provision to the contrary exist when either property is transferred. If the full opening phrase, which states, “The existence of an apparent sign of a continuous easement between two properties...,” is read in light of its historical development, it must be interpreted to mean that the apparent sign is continuous before and after the property is transferred. In other words, there is an intent to preserve it, since one means of extinguishing it is to remove the existing apparent sign or expressly stipulate its removal in the deed. This is the correct interpretation and should therefore be applied where the apparent sign relates to a right-of-way easement.

Indeed, in discussing its origins, Italian legal scholarship links this easement to the virtues of the Roman peasant “sui iuris,” who, when placed at the head of a rural estate, organizes and directs the forces of nature (Giorgianni, Buon padre di famiglia, Noviss. DI, II, 1958, 597, cited by BUSNELLI et al., op. cit., page 263). It is therefore permissible to create this type of easement by destination of the owner for right-of-way easements, which are discontinuous and apparent. This has also been recognized in the case law of the Sala Primera de Casación de la Corte Suprema de Justicia in judgment No.

380-F-00 at 16:45 on 19 de mayo del 2000, which, with regard to a specific case similar to the one before us, stated as follows: “V.- Regarding the first issue, which leads to whether or not Article 380 of the Civil Code applies and whether there is a duty to pay compensation if a compulsory right-of-way easement (servidumbre forzosa de paso) is established, the following must be noted. That provision states: ‘The existence of an apparent sign of a continuous easement (servidumbre continua) between two properties, established by the owner of both, shall suffice for the easement to continue actively or passively, unless, when ownership of the two properties is separated, the deed of conveyance of either property states otherwise.’ (Emphasis not in the original). According to the plain wording of that article, one of the indispensable requirements for this method of establishing an easement is that the two properties belong to a single owner.

Based on the proceedings and the certified documents submitted with the appeal, we agree with the appellant in cassation that this requirement is absent in the case at bar... Furthermore, this Chamber considers the existence of apparent signs of an easement at the time the land was subdivided to be questionable... That is, the continuous line indicating the existence of the easement does not cross that property.... Lastly, as this Chamber has repeatedly held, compensation for the value of the land and for any other loss is an inherent element of a compulsory easement. In this regard, among many others, judgments numbers 80 at 14:30 hrs. on 19 de julio de 1995; 17 at 14:30 hrs. on 20 de enero; and 129 at 14:10 hrs. on 26 de marzo, the latter two from 1999, may be consulted. Our legal system, like others such as those of Argentina, Italy, and Spain, provides an exception to that rule. The exception applies when the landlocked status of the property results from a legal transaction.

In such cases, the easement must be established in favor of the property that became landlocked by virtue of the transaction, without any compensation. This is provided by Article 400 of the Civil Code. In the present case, as noted above, this is not applicable because the properties never belonged to the same owner. It follows from the foregoing that the case at bar does not involve an easement created by destination of the owner (servidumbre por destino de padre de familia), but rather a compulsory right-of-way because the property is landlocked. The foregoing factual and legal reasons are sufficient to reach that conclusion. It is therefore unnecessary to address the other arguments advanced for that purpose. Furthermore, because the exception provided for in the Civil Code does not apply, all defendant owners whose properties will be affected by that encumbrance are entitled to compensation for the value of the land required to establish it, as well as for any other loss (Articles 395 and 400 ibídem).” (end of quotation; underlining not in the original).

That decision shows that Costa Rican case law recognizes the establishment of an easement by destination of the owner when two requirements are invariably met, namely: 1) the properties belonged to the same owner; and 2) continuous lines existed as apparent signs indicating the existence of the easement. Part of our legal scholarship reaches the same conclusion, stating: “An easement by destination of the owner does not continue; rather, it ‘is established’ upon the conveyance of one of the properties affected by that situation. Article 531 of the Spanish Civil Code contains the same inaccuracy. It has been established that the expression ‘two properties’ may apply where the owner of a single property imposed an encumbrance on one portion of it for the benefit of another before dividing it...” (SOTELA MONTAÑE, Rogelio (commentary), in: BRENES CORDOBA, Alberto, Tratado de los Bienes, Juricentro, 1981, p. 112).

Another author emphasizes the following: “If we review our legislation, we see that Article 380 states that the easement will continue when the property is divided or when one of the original owner’s properties is transferred to another titleholder; what actually occurs is the transformation of a mere service between portions or properties belonging to the same titleholder, because the previously discussed principle ‘nemini sua servit’ applies. It is important to bear in mind that, in this situation, the service already existed and continues upon the severance (segregación) of the property or the transfer of ownership of one property to another titleholder” (SANCHEZ BOZA, Roxana. Estudio de la Jurisprudencia judicial y administrativa respecto de las servidumbres. Universidad de Costa Rica, 1985, p. 98). Notwithstanding the foregoing, some still advocate a restrictive application of the doctrine, limited to continuous and apparent easements (BRENES CORDOBA, op. cit., p. 112, CHINCHILLA, José.

Precisiones conceptuales sobre la regulación de la servidumbre por destino del padre de familia. En. Revista Jurídica Vox Iuris, UIA, Año 2, No. 1, 2005, p. 16-19). However, that interpretation is inconsistent with the economic and social needs of productive agricultural property, as discussed below. X.- The agrarian case law of the First Chamber of Cassation of the Corte Suprema de Justicia has established the connection between agricultural easements (servidumbres agrarias), the productive purpose of the properties, the agricultural enterprise (empresa agraria), and the purpose assigned to productive properties by a prudent owner (buen padre de familia). In this regard, it stated: “A fundamental element within the structure of the agricultural enterprise is its organization. Both tangible and intangible assets (instrumenta fundi) participate in that organization. The rights acquired by the owner of the property (iura fundi) as a result of engaging in agriculture, and in view of their necessity or usefulness for agricultural production, constitute a valuable instrument within its organizational structure.

Ordinarily, the ‘iura fundi’ are identified with the predial easements (servidumbres prediales) of Roman law, which were formerly classified as res mancipi. They are the so-called ‘rights’ of the property and form part of the agricultural estate viewed as an organized property. A property’s ‘need for water’ for cultivation or for access to a public road, in order to communicate with the outside, creates rights in favor of the landlocked property. The utility of one property is used by another property. But these rights do not always coincide with the predial-easement rights governed by the Civil Code. The easements characteristic of Roman law (iter, via, actus, aquae ductus) were, as noted, classified as res mancipi. Together with slaves, livestock, facilities, and farming implements, they comprised the instrumentum fundi, that is, the organization of the agricultural estate. This construct was possible because an easement was understood as an ius fundi, which was exercised through material control (mancipium) over the portions of the servient estate (fundo sirviente) intended to improve the use of the dominant estate (fundo dominante).

This ancient conception of the agricultural easement was tied to the public-law conception of rural property as sovereign ownership and was superseded within the new private-law conception of Roman property. Under modern law, an easement cannot be conceived as an appurtenance. Some of its characteristic elements, such as intended use (destinación), nevertheless remain and take on significant importance. In the instrument establishing the easement, the owner of the dominant estate intends to assign it to the organization of that estate, thereby obtaining an economic benefit from the other property. The intended use of a ‘prudent owner’ is essential to explaining the economic and social function of establishing the easement. This function is linked to a deliberate choice by the owner of the dominant estate, who sought to obtain some benefit from another property so that it could be devoted to the owner’s own use.” (No. 80 at 14:30 on 19 de julio de 1995)...” (boldface not in the original).-

IX.REGARDING THE SUBSTANTIVE GROUNDS OF APPEAL CONCERNING THE ACQUISITION OF AN EASEMENT (SERVIDUMBRE) BY ACQUISITIVE PRESCRIPTION (PRESCRIPCIÓN POSITIVA) AND BY REASON OF LANDLOCKED PROPERTY (ENCLAVE): The appellant is correct, but those grounds are insufficient to reverse the appealed judgment, which shall be affirmed, albeit for reasons other than those relied upon by the Court of First Instance. Indeed, the substantive grounds of appeal asserting that an easement may not be established by adverse possession (USUCAPIÓN) are well-founded, whereas the landlocked status of the property is irrelevant in an action to deny an easement (ACCIÓN NEGATORIA). This is because the appealed judgment does not dismiss the claim on those grounds; therefore, those grounds of appeal bear no relation to the ruling. The substantive grounds of appeal examined herein are rejected.-

X. REGARDING THE SUBSTANTIVE GROUNDS OF APPEAL CONCERNING THE FAILURE TO PROVE THE EXISTENCE OF THE EASEMENT

The appellant is incorrect. The ground asserting that no instrument establishing an easement pursuant to Articles 378 and 308 of the Civil Code was proven is well-founded, but insufficient to reverse the challenged judgment. Having assessed the evidence under the free evaluation of evidence (LIBRE VALORACIÓN DE LA PRUEBA) system set forth in section 56 of the Agrarian Jurisdiction Law (LEY DE JURISDICCIÓN AGRARIA), this Court concludes that the tacit agreement between the former owners of the properties (the brothers Pedro, José Angel, and Roberto Prado Segura) gave rise to an easement by destination of the common owner (SERVIDUMBRE DE DESTINO DE PADRE DE FAMILIA), pursuant to Article 380 of the Civil Code. Consequently, the action to deny the easement cannot succeed because the claimant lacks a legal right. The appellant is incorrect in asserting that it was not proven that her property is burdened by an easement by destination of the common owner.

Such proof may be drawn from the very evidence offered by the appellant as evidence obtained by the court for purposes of rendering a better-informed decision (PRUEBA PARA MEJOR RESOLVER), as well as from the historical registry entries for the properties from which the parties’ properties originated. The evidence should be examined to determine chronologically how the easement by destination of the common owner was established. History of property 548944-000, owned by the plaintiff: On 11 de agosto de 1956, Claudio Fallas García sold property 139456 to Pedro Prado Segura (certified copy of the deed admitted as evidence obtained by the court for purposes of rendering a better-informed decision, at image 10 of the appeal). Nine years later, on 24 de abril de 1965, Roberto, Pedro, and José Angel Prado Segura, each owning an equal share of property 154579, sold that property to Azucena Prado Segura (registry entry at image 84).

On that same day, Azucena Prado Segura sold property 154579 to Pedro Prado Segura, and it became property 177426 (registry entry at image 84). Registered property 548944-000 resulted from the consolidation (REUNIÓN) of registered properties 139456 and 177426, which belonged to Pedro Prado Segura. Their consolidation and his sale thereof to PRADO DEL SUR Y ASOCIADOS SOCIEDAD ANÓNIMA were effected through public deed No. 53 executed at diez horas del diez de julio del dos mil cuatro before Notary Juan Edgar Fallas García (public deed at images 5 and 6 of the electronic case file). Eight years later, PRADO DEL SUR Y ASOCIADOS SOCIEDAD ANÓNIMA sold property number 548944-000 to the plaintiff through public deed No. 91 executed at once horas del veinte de abril del dos mil doce before Notary Juan Edgar Fallas García. Thus, when she acquired it, she knew that the road was being used, given the family relationship that existed between the owners of the servient estate (FUNDO SIRVIENTE) and the dominant estate (FUNDO DOMINANTE), and because she had lived her entire life on the property of her father, Pedro Prado Segura.

She acknowledged this in the plaintiff Ana Isabel Prado Chinchilla’s examination as a party (DECLARACIÓN DE PARTE), in the audio incorporated on 15/02/2022 13:49:08, in which she acknowledged that the road had existed for a long time when the property belonged to her father. History of property 612150-000, co-owned by the defendants: On 24 de abril de 1976, Roberto Prado Segura subdivided and sold a lot from his property 248899 to his brother José Angel Prado Segura, thereby creating property 248901 (registry entry at image 75). On that same day, 24 de abril de 1976, Pedro, Roberto, and José Angel Prado Segura, as owners of equal shares in property 248893, divided it into three lots, one of which, number 2, was awarded to José Angel Prado Segura, thereby creating property 248897 (registry entry at image 78). It was also proven that Mr. José Ángel Prado Segura, as the former owner of registered properties 248901-000 and 248897-000, now property 612150, interests 001 and 002, had used the road at issue pursuant to a verbal agreement with his brothers Roberto and Pedro, who, like him, were co-owners of property 154579, which became property 177426 and, upon consolidation, formed what is now the plaintiff’s property 548944-000.

Mr. José Angel used the road as the sole means of access—on foot, on horseback, or by vehicle—to his property, where he had his home and engaged in farming and livestock raising, as demonstrated by the testimony of Aurelio Mora Cruz in audio 15/02/2022 13:50:08, Marvin José Prado Monge in audio incorporated on 15/02/2022 13:50:31, and Noé Eduardo Elizondo Arias in audio incorporated on 15/02/2022 13:49:44. Subsequently, in 2003, registered property number 612150, interests 001 and 002, came into existence through the consolidation of properties 248901-000 and 248897-000. Their former owner, José Ángel Prado Segura, consolidated them and donated the resulting property to his sons Ilver Antonio Prado Monge and Marvin Prado Monge through public deed No. 41 executed at ocho horas del once de setiembre del dos mil tres before Notary Sergio Vidal Zúñiga López (public deed at images 18 and 19 of the electronic case file).

The use of the road at issue on the plaintiff’s property bears apparent signs (SIGNOS APARENTES) of its existence. The road is depicted on cadastral plan (PLANO CATASTRADO) SJ 815296-2002; it begins at vertex 14, running west-east, where there is a metal gate facing a public road; it then reaches another metal gate located in the plaintiff’s pasture area; and, finally, a small gate marking the boundary between the plaintiff’s property and the property of an adjoining third party named Adolfo Valverde. The route continues through that third party’s property until it reaches the defendants’ property, as demonstrated by the cadastral plan at image 3 of the electronic case file, the audio recording of the judicial inspection (RECONOCIMIENTO JUDICIAL) incorporated on 16/07/2021 16:11:57, and the videos recorded on compact disc. Article 380 of the Civil Code provides that: “The existence of an apparent sign of a continuous easement between two properties, established by the owner of both, is sufficient for the easement to remain in effect, actively or passively, unless, at the time ownership of the two properties is separated, the conveyance instrument for either property expressly provides otherwise.” Legal scholarship states regarding that provision: “In the case of easements, it is required that the OWNER OF both properties have left an apparent sign of service between them” (ALBALADEJO, (Manuel).

Derechos Reales: Iura in Rei Aliena comentado para Costa Rica por Ricardo Zeledón, Tomo III, San José, EIJSA, 2012, p. 189. Given that the brothers Pedro, Roberto, and José Angel, all surnamed Prado Segura, were co-owners in equal shares of the properties from which the parties’ properties originated, and that since 1956 they established the right of way (PASO) benefiting what is now the codefendants’ property across what is currently the plaintiff’s property, with apparent signs that have not disappeared to this day and with no provision to the contrary having been established to date, the existence of an easement by destination of the common owner has been proven. Therefore, the grounds of appeal are unfounded, and the challenged judgment must be affirmed for the foregoing reasons.

XI. ADDITIONAL REASONS OF JUDGE ULATE CHACÓN

The undersigned concurs with the majority opinion but considers it necessary to offer some additional observations regarding the statutory interpretation of the Civil Code in light of the text of the Political Constitution, the principles of Agrarian Law, and the evolution of rights in rem (derechos reales) in comparative law. Indeed, for more than 15 years, this Agrarian Court has adopted a systematic, substantive, and evolutionary interpretation of the provisions concerning the importance of agrarian easements (servidumbre agraria) and, in particular, right-of-way easements (servidumbre de paso), establishing in specific cases the need to proceed from the principle of the economic, social, and environmental function of agrarian property and of rights in rem over another’s property (derechos reales en cosa ajena), or limited rights (derechos limitados), such as easements. 1.- European legal scholarship, particularly Spanish scholarship (Busto Lagos, José Manuel.

Acquisitive Prescription of Title to a Right-of-Way Easement. Legal Monographs directed by Manuel Albaladejo García and silvia Díaz Alabart; Madrid, España, Edersa, 2000), has very soundly developed the shift in Spanish case law. In Costa Rica as well, extensive consideration has been given to the need and usefulness of reinterpreting the Civil Code provisions so as to accept not only the acquisitive prescription (usucapión) of right-of-way easements, but also tacit agreements (convenio tácito). (García Murillo, José Daniel and Barboza Castro, Natalia. “Recognition of Acquisitive Prescription and Tacit Agreements in the Acquisition of Right-of-Way Easements in Costa Rica.” Undergraduate thesis submitted for the Licentiate Degree in Law. Facultad de Derecho, Universidad de Costa Rica, 2024. Pages 141 to 146.). Regarding the first issue, related to prescription of the easement (prescripción de la servidumbre), the appellant raises the matter on appeal and it is addressed in the response; therefore, this Court could properly examine that acquisitive prescription, or positive prescription (prescripción positiva), pursuant to Article 851 of the Civil Code: “Waiver of prescription may be tacit; and results from failing to raise the defense before the judgment becomes final, or when the person entitled to raise it demonstrates through an act of their own that they recognize the right of the owner or creditor.” Accordingly, the appellant’s argument would not be valid, nor is it acceptable to apply a nineteenth-century interpretive approach derived from a literal reading of Articles 378 and 379 of the Civil Code.

This is because, in this case, it is abundantly clear that, for more than 50 years, there have been visible, apparent signs manifested through external features (roadway, boundaries, continuous use), which were recognized by both the original owners and their transferors and most recent purchasers. This was public, peaceful, and uninterrupted possession (posesión pública, pacífica e ininterrumpida), further grounded in tacit consent that constitutes lawful title (justo título), or the legal basis for acquiring the right in rem of an agrarian easement. The legal scholarship cited above, as well as modern Civil Codes, do not even retain the distinction between continuous and apparent easements (servidumbres continuas y aparentes), on the one hand, and discontinuous easements and continuous non-apparent easements (servidumbres discontinuas y continuas no aparentes), on the other. This is because that distinction was superseded by the legislature and by judicial interpretive criteria consistent with agrarian and urban realities, with due regard for the full exercise of the economic, social, and environmental function of agrarian property.

The agrarian easement serves the productive use of real property and forms part of the land-based rights (derechos fundiarios) (iura fundi) of the agrarian enterprise (hacienda agraria), supporting productive agrarian business activities—in this case, for more than fifty years. These are existing easements, accepted through tacit agreement and transferred together with the dominant and servient properties (inmuebles dominante y sirvientes) from generation to generation. A tacit agreement arises from a legal transaction (negocio jurídico), in this case an oral agreement reflecting a meeting of the minds whereby the owner of the servient estate (fundo sirviente) grants the easement for the benefit of the dominant estate (fundo dominante). A sound interpretation of Article 308, which provides: “in the case of continuous non-apparent easements or discontinuous easements, the claim, in order to be admissible, must be based on title originating from the owner of the servient estate or from those from whom that owner acquired it.” In addition, Article 379 states: “discontinuous easements of every kind and continuous non-apparent easements may be created only by agreement or by testamentary disposition.

Possession, even from time immemorial, is insufficient to establish them.” As legal scholarship correctly indicates, the possibility of creating a right-of-way easement through a tacit agreement represents an alternative to prescription, with proof of the existence of such an agreement being the sole requirement. The Civil Code does not explicitly define what constitutes an “agreement” or “title,” leaving open the possibility that it may be written, oral, or inferred from facts supporting the intent of the owner of the servient estate, in concurrence with that of the owner of the dominant estate, pursuant to Article 1022 of the Civil Code (the agreement is law between the parties). And indeed, as will be seen, one such manifestation of a tacit agreement is an easement created by disposition of the common owner (servidumbre por destino de padre de familia). It is therefore essential to ascertain the intent of the parties, especially that of the owner of the servient estate.

The intent to create the right-of-way easement through a tacit agreement is supported by the broad conception of an agreement adopted by the Civil Code, as set forth in Article 1008, which provides: “The consent of the parties must be freely and clearly expressed. It may be expressed orally, in writing, or through acts from which it necessarily follows.” Accordingly, in this specific case, the agreement is established by the facts deemed proven, which demonstrate not only the intent of the owner of the servient estate to grant the easement, but also the intent of the owner of the dominant estate to receive it and use it for the utility and exercise of the social function of property. 2.- In Resolution number 878 of 2013, this Agrarian Court held as follows in a specific case: “There can be no doubt that the obligation to grant rights of passage (derechos de paso) between neighboring properties forms part of the social and economic function of property and is an element of the country’s social peace and an indispensable requirement for production in our agrarian areas.

Updating the concept of easement from a constitutional perspective requires us to reconsider the purely doctrinal view that characterizes a right-of-way easement as discontinuous and, on that basis, denies acquisitive prescription based on possession of the easement. When the rules of logic are applied to agrarian easements, use of the passage will occur according to the needs of cultivation, in order to remove harvests or bring supplies, materials, or labor to the worksite. Repeated use for those activities would imply the existence of a tacit agreement between the parties, unless the circumstances of the case demonstrate mere tolerance (mera tolerancia), which has other characteristics, such as being a unilateral act and probably involving a shorter period of use, together with the absence of other factors, such as trust or familiarity between the parties. II The concept of an agreement under the law, custom as a source of law for agrarian right-of-way easements, and the requirements of possession.

Irrespective of what was stated in the preceding analysis, national law does recognize an agreement as a means of acquiring a discontinuous and apparent easement (servidumbre discontinua y aparente), both in the case of continuous and apparent easements and in that of discontinuous easements (Articles 378 and 379 of the Civil Code). With regard to the meaning of agreement, the celebrated jurist Guillermo Cabanellas defines it as: ‘a meeting of the minds, expressed in a convention, covenant, contract, treaty, or arrangement. Synonymous with any of these words implying agreement, owing to the flexibility and widespread use given to the term agreement, notwithstanding the technical distinctions specified under each corresponding entry.’ (Guillermo Encyclopedic Dictionary of Common Law, Volume 2, Editorial Heliasta. p. 365). As Guillermo Cabanellas correctly states, an agreement is a flexible legal institution in which the essential element is that consent be expressed—what he calls a meeting of the minds.

In Costa Rican rural life, an agreement is a highly important source of law, ordinarily expressed orally through custom. In this regard, it is important to distinguish a tolerated act (acto tolerado) from an agreement. Tolerance is typically a unilateral act expressing the intent of the person granting it to permit conduct or certain acts, subject to the condition that it may be revoked at any time without any claim by its beneficiary. In an agreement, even an oral one, there is a clear expression of the parties’ consent. Proving that consent is a matter of evidence. Evidently, although the law states that possession, even from time immemorial, is insufficient to create easements that it calls discontinuous and apparent, such as a right-of-way easement, it is legally correct to affirm that, when assessing evidence of a tacit agreement, the existence of peaceful, public, and uninterrupted possession of a passage under a claim of ownership (a título de dueño) constitutes evidence of great importance.

Refusing to accept the foregoing would render the institution of possession ineffective, despite its meticulous regulation in our legal system. The requirements imposed for a right of possession (derecho de posesión) to be recognized as such are those set forth in Article 856 of the Civil Code, namely: possession as an owner in a continuous, public, and peaceful manner. In the case of a passage, those requirements would make it necessary for the person using it to regard themselves as the owner of the right thereto and for such use to be continuous, without this meaning permanent use of the passage, as that would be contrary to logic—as we have already stated. What would actually be required is regular use, a contrario sensu, as established by the law itself concerning loss through nonuse, as well as for the use to be public and peaceful. (...) Finally, it must be recalled that our law follows the system of transfer of property by mere consent (nudo consenso); thus, the easement need not be registered in order to take full legal effect between the parties who agreed to it through a tacit agreement (Article 480 of the Civil Code) (Tribunal Agrario, Vote No. 878 of 16 September 2013).- 3.- An easement created by disposition of the common owner is an evident manifestation of a tacit agreement (as occurs in this case).

Article 380 of the Civil Code provides: “The existence of an apparent sign of a continuous easement between two properties, established by the owner of both, is sufficient for the easement to continue actively or passively, unless, at the time ownership of the two properties is separated, the title transferring either of them states otherwise.” First, it is relevant to note that the provision does not require a written title to create this easement, thereby permitting the existence in our legal system of implied or tacit titles (títulos mudos o tácitos), based on the features or appearance demonstrating its existence between the two properties, as in this case. In accordance with the reasoning of the Sala Primera in Judgment No. 380-F-00 at 16:45 hours on 19 May 2000, the interpretation of the provision is clarified as follows: According to the literal wording of that article, one of the indispensable requirements for this method of creating an easement to apply is that the two estates belong to a single owner.

In accordance with the proceedings and the certifications submitted with the appeal, we agree with the appellant in cassation that this requirement is missing in the case under review. On the other hand, this Chamber considers the existence of apparent signs of an easement (servidumbre) at the time the land was subdivided to be questionable. That is, the continuous line marking that denotes the existence of the easement does not cross that property. Lastly, as this Chamber has repeatedly held, compensation for the value of the land and for any other damage is an inherent element of a compulsory easement (servidumbre forzosa). Our legal system, like others, including those of Argentina, Italy, and Spain, provides an exception to that rule. This occurs when the landlocked status of the property results from a legal transaction. In such cases, the easement must be established, without any compensation, in favor of the dominant estate that became landlocked as a result of the transaction.

This is provided by Article 400 of the Civil Code. In this case, as noted above, that is not the situation, because the properties never belonged to the same owner. It follows from the foregoing that the case under review does not involve an easement by destination of the common owner (servidumbre por destino de padre de familia), but rather a compulsory right-of-way easement (servidumbre forzosa de paso), because it involves a landlocked property. The factual and legal grounds set forth above are sufficient to reach that conclusion. It is therefore unnecessary to address the other arguments advanced for that purpose. Furthermore, because the exception provided for in the Civil Code does not apply, all defendant owners whose properties will be affected by that encumbrance are entitled to compensation for the value of the land required to establish it, as well as for any other damage (Articles 395 and 400 ibídem).

First Chamber of Cassation, Judgment No. 380-F-00 of 16:45 on 19 de mayo del 2000.- The cited excerpt shows that Costa Rican case law accepts the establishment of a right-of-way easement by destination of the common owner, for which two essential elements must be satisfied: 1) that the properties belonged to the same owner; and 2) that the existence of continuous lines or apparent signs indicating the existence of the easement be proven. The same case law of the First Chamber has recognized the establishment of easements by destination of the common owner, which may arise from a silent title (título mudo), that is, from the existence of apparent signs or lines denoting such an easement. Therefore, a written instrument issued by the owner of the properties affected by this easement is not required, thereby allowing an easement to be established through an implied agreement (convenio tácito).

(García Murillo, José Daniel and Barboza Castro, Natalia. “Recognition of Acquisitive Prescription and Implied Agreements in the Acquisition of Right-of-Way Easements in Costa Rica” (“El reconocimiento de la usucapión y el convenio tácito en la adquisición de las servidumbres de paso en Costa Rica”) Undergraduate thesis submitted for the Licentiate Degree in Law. Faculty of Law, Universidad de Costa Rica, 2024. Pages 141 to 146.). 4.- This Court, even in summary proceedings (sede sumaria), has reflected on the importance of protecting a right-of-way easement in the case of landlocked properties, leaving the issue of the existence of consent and an implied agreement to declaratory proceedings (vía declarativa). Thus, Voto No. 494 of 22 de mayo del 2024 stated as follows: “VIII.- ..Logically, protection applies when an agricultural entrepreneur is threatened in the conduct of his or her economic activity by facts or acts that disturb that agricultural possession (posesión agraria), or that partially or entirely dispossess that person of the property or of the so-called ‘iura fundi,’ meaning rights over which current and immediate possession is exercised and which are useful for the continuous, stable, and effective conduct of the productive activity.

This may occur, for example, when the passageway or road used to remove agricultural production, whether crops or animals, is closed, which may cause harm to the agricultural entrepreneur because of the inability to continue harvesting or obtaining the product as a result of the closure of the passageway or road.- Third, it is important to recall that, under settled agricultural case law, an agricultural easement (servidumbre agraria), specifically a right of way, has been regarded as a property right that, since Roman times, has been highly useful in enabling properties to fulfill their economic, social, and now environmental function. It has indeed been regarded as an ‘iura fundi’ serving real property or agricultural estates that require access to a public road, as well as access suitable for conducting the economic activity. These ‘iura fundi,’ or rights over the property, may be established or created in the manners provided by the legal system itself.

Depending on the nature or type of easement, certain legal classifications were made by the nineteenth-century legislature (the Civil Code dates from 1988), and some classifications do not correspond to agricultural reality. It is therefore important to clarify certain concepts in order to decide this case in light of the most modern legal scholarship and case law, without losing sight of the fact that this is a possessory protection proceeding (interdicto de amparo de posesión), and that ownership rights and definitive property rights are not adjudicated in these proceedings, which, as stated, are intended to protect productive agricultural activity. Accordingly, it is important to consider that although a right-of-way easement has been characterized as a ‘discontinuous and non-apparent’ easement (servidumbre discontinua y no aparente), the agricultural reality of properties often shows otherwise because of visible signs arising over time and the continuity of agricultural activity.

Thus, the existence of visible signs, the continuity of an easement, and statements by the parties could support characterizing the arrangement as a possible agreement between the parties concerning the existence of an agricultural right-of-way easement, but that issue properly belongs in declaratory proceedings. Moreover, even under a likelihood assessment (juicio de verosimilitud), it is important to recall that when reference is made to a property being ‘landlocked’ (enclave), the legal system provides for two situations: the property has no access at all, or it lacks adequate access to a public road for the proper conduct of its productive agricultural activity (Article 395 of the Civil Code). Fourth, it is important to consider that where continuous productive agricultural activities exist, particularly dairy farming, the production and utilization cycle (milking) is plainly continuous, and the animals’ physical condition must be taken into account.

That continuous activity means that this is not an act of partial or sporadic enjoyment, as might be the case with a watering easement (servidumbre de abrevadero), but must instead involve continuous and full enjoyment for purposes of carrying out the productive activity twice a day. This perspective distinguishes the exercise of continuous, stable, and productive agricultural possession from an act of mere tolerance (acto de mera tolerancia), understood as partial enjoyment of the property with the consent of the neighbor or owner of the property over which that mere tolerance is exercised (Brenes Córdoba). Clearly, permissive acts (actos facultativos) or acts of mere tolerance, understood as partial enjoyment, do not confer possessory rights (Article 279 of the Civil Code). Mere tolerance is therefore a unilateral act by the owner or possessor allowing partial enjoyment, which is different from both parties contributing to the construction of access between one property and another, as apparently occurred in this case, as we shall see.”. 5.- In this particular case, we are faced with an ordinary claim seeking a declaration that no encumbrance exists (acción negatoria), which the defendant opposed by asserting that the easement has existed for more than fifty years.- As stated in the majority’s substantive considerations, the easement was indeed established by agreement between siblings who jointly owned the two properties (servient and dominant), which would lead to the existence of an easement by destination of the common owner that was not disclaimed in the various transfers among the successive purchasers (relatives).

The emphasis, however, is on the agreement.- Now, if we proceed from the premise of the action seeking a declaration that no encumbrance exists, Spanish legal scholarship must again be recalled: “Legal scholarship and case law accept that, although the C.C. does not provide for this possibility as a general matter, the owner of an estate has the so-called ‘action seeking a declaration that no encumbrance exists’ to defend the integrity of the owner’s title against any alleged restriction arising from the exercise of possession, in this case of the limited property right (derecho real limitado) consisting of a right-of-way easement, by requesting that the competent judicial body issue a judgment declaring the alleged encumbrance nonexistent and restoring full ownership. It appears clear that if the right to bring this action were barred by the passage of a specified period, the owner of the alleged servient estate could not bring it against the possession’s capacity to give rise to acquisitive prescription (poder ad usucapionem), regardless of whether or not the acquisitive effects of that possession had been completed...” (Busto Lago, op.cit., p. 289).

It follows from the foregoing that an action seeking a declaration that no encumbrance exists would not lie if the easement has been legally established through proof of an implied agreement, as occurred in this case, reinforced by the fact that, after a designated and continuous use for more than ten years, the easement was not disclaimed in the instruments transferring title or in the real property registry information, which includes the physical description of the easement in the registered cadastral plans.-

POR TANTO

The judgment is affirmed as to the matters appealed, for the reasons explained herein. Judge ULATE CHACÓN provides additional reasons for affirming the judgment.- ????????????????

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las trece horas cincuenta y tres minutos del once de julio de dos mil veinticuatro.- PROCESO ORDINARIO incoado por ANA ISABEL PRADO CHINCHILLA, mayor, soltera, agricultora, vecina de Cartago, La Unión, San Rafael, cédula de identidad uno - quinientos ochenta y nueve - quinientos treinta y seis; contra CARLOS RODOLFO MORA SOLANO, mayor, casado, agricultor, vecino de San José, Acosta, Cangrejal, cédula de identidad uno - mil ochenta - cuatrocientos treinta y cuatro; ILVER ANTONIO PRADO MONGE, mayor, soltero, agricultor, vecino de San José, Acosta, Cangrejal, cédula de identidad uno - quinientos sesenta y seis - seiscientos cincuenta y ocho. Actúa como apoderado especial judicial de la parte actora, el licenciado Ricardo Salazar Hidalgo, cédula de identidad dos - cuatrocientos treinta y dos - cero dieciocho, colegiado veintiún mil cien; y como abogado director de los demandados, el licenciado Carlos Manuel Monge Monge. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de San José, Goicoechea.

Redacta el juez Picado Vargas; y,

CONSIDERANDO:

I.De las pretensiones: La parte actora formuló el presente proceso ordinario para que en sentencia se declare lo siguiente: “1. Que se declare que la señora Ana Isabel Prado Chinchilla es la única y exclusiva propietaria y poseedora del inmueble inscrito en el Registro Inmobiliario en el Partido de San José, bajo la matrícula de Folio Real número 548944-000. 2. Que se declare que sobre la propiedad con matrícula de Folio Real N°: SJ- 548944-000 no existe un derecho real de servidumbre agrícola o servidumbre de paso, a favor ni en contra de esta. 3. Que se declare la extinción de cualquier derecho de paso que existiera por mera tolerancia en la propiedad de mi representada, y que los codemandados, sus familiares, peones o cualquier otra persona que en sus nombres quieran ingresar, se abstengan de hacerlo en lo sucesivo, pues la actora de la demanda establece la terminación de la mera tolerancia. Esto bajo pena de ser procesados por el delito de desobediencia a la autoridad, si no cumplen con lo ordenado por la autoridad judicial. 4. Que en caso de oposición de la presente demanda, se condene a los codemandados en forma solidaria, al pago de ambas costas de esta acción.” (ver escritorio virtual del Juzgado Agrario de San José, escrito incorporado el 21/04/2021 04:10:52).

II.Debidamente notificados los accionados contestaron negativamente la demanda formulada en su contra. (Ver escritorio virtual del Juzgado Agrario de San José, escrito incorporado el 09/06/2021 02:47:08)

III.La Jueza Vanessa Fisher González, del Juzgado Agrario del Segundo Circuito Judicial de San José, Goicoechea en sentencia 2023000033 de las uno horas treinta y seis minutos del ocho de febrero de dos mil veintitrés, resolvió: “POR TANTO: De acuerdo a lo expuesto y citas de ley se declara SIN LUGAR en todos sus extremos la demanda interpuesta por ANA ISABEL PRADO CHINCHILLA contra CARLOS RODOLFO MORA SOLANO e ILVER ANTONIO PRADO MONGE, todos de calidades citadas. Se resuelve sin especial condenatoria en costas (Ver escritorio virtual del Juzgado Agrario de San José sentencia de primera instancia incorporada el 08/02/2023 01:36:39).

IV.Se admite como prueba para mejor resolver la prueba documental ofrecida por la parte actora en su recurso de apelación de conformidad con el artículo 52 de la Ley de Jurisdicción Agraria.-

V.Se prohíja el elenco de hechos tenidos por demostrados por ser acordes al acervo probatorio. De esta naturaleza, se tiene por demostrados los siguientes hechos: 13.- El día 11 de agosto de 1956, Claudio Fallas García vende a Pedro Prado Segura la finca 139456 (testimonio de escritura admitida como prueba para mejor resolver a imagen 10 del recurso de apelación). 14.- El 24 de abril de 1995, Roberto, Pedro y José Angel Prado Segura dueños por partes iguales de la finca 154579 venden dicha finca a Azucena Prado Segura (asiento registral a imagen 84). 15.- Ese mismo día, Azucena Prado Segura vende a Pedro Prado Segura la finca 154579 y se convierte en la finca 177426 (asiento registral a imagen 84). 16.- El 24 de abril de 1976, Roberto Prado Segura segrega y vende de su finca 248899 un lote a su hermano José Angel Prado Segura creando la finca 248901 (asiento registral a imagen 75). 17.- El 24 de abril de 1976, Pedro, Roberto y José Angel Prado Segura como dueños por partes iguales de la finca 248893, la dividen en tres lotes , uno de ellos, el número 2 se lo adjudica José Angel Prado Segura. Creando la finca 248897 (asiento registral a imagen 78).-

VI.El licenciado Ricardo Salazar Hidalgo, en su condición de apoderado especial judicial de Ana Isabel Prado Chinchilla, interpuso recurso de apelación contra dicha resolución, manifestando lo siguiente: "MOTIVOS O AGRAVIOS: PRIMER MOTIVO. ERRONEA FUNDAMENTACIÓN ANALITICA O INTELECTIVA CON RESPECTO A UN SUPUESTO CONVENIO SOBRE CONSTITUCION DE SERVIDUMBRE. El A quo yerra al valorar la prueba, y analizarla para arribar como resultado de que la servidumbre que se alega no existe, en realidad si se constituyó por medio de un supuesto convenio suscitado verbalmente entre los dueños originales de los fundos dominantes y sirvientes, que eran los hermanos José Ángel Prado Segura (difundo en enero del año 2006), padre del codemandado Iver Prado Monge y el señor Pedro Prado Segura (difunto en julio del año 2020), padre de la actora Ana Isabel Prado Chinchilla.Llama la atención que la Tesis del supuesto Convenio Verbal no fue desarrollada ni probada por la parte demandada, que se enfocó en alegar dos situaciones:

  • 1)que dicha servidumbre si estaba inscrita porque aparecía graficada en el plano catastrado de la propiedad de la actora y aparecía la servidumbre como uno de los linderos en la certificación literal de la propiedad de la actora; y
  • 2)Que aunque no se reconociera la inscripción del gravamen de servidumbre, por el plazo de más de 50 años de uso ya había operado la prescripción positiva. Ambas tesis desarrolladas por la parte demandada fueron rechazadas como debía ser, por el A quo. Pero erróneamente la jueza si desarrolla la tesis de que sí había operado un convenio tácito entre los padres y antiguos dueños de los fundos de la parte demandada y la parte actora, basado en supuestos indicios como: a) el uso inmemorial de la servidumbre, b) el que la servidumbre estuviera graficada en el plano de la propiedad de la actora, y c) que en la certificación registral de la propiedad de la actora aparece como colindante este la servidumbre de paso. Esto se logra determinar cuando en lo literal el A quo dice en la sentencia recurrida: Asimismo, si se analiza el plano catastrado de la finca que era de Pedro (hoy de la actora), se infiere que el plano catastrado No. SJ-815296-2002 (imagen 3), describe ese camino como "servidumbre" el cual conduce hacia finca de los demandados. Ese plano fue levantado en el 2002, cuando de acuerdo a lo analizado en considerandos anteriores, pertenecía la finca sirviente a Pedro Prado y la dominante a José Ángel Prado, de manera que razonablemente se puede tener por acreditado el convenio. Aunque un plano catastrado por sí mismo no basta para constituir una servidumbre, el punto acá es que en virtud del principio de unidad de la prueba, si se valora ese documento con la contundente posesión ejercida por los dueños del fundo dominante, se colige con meridiana claridad que efectivamente se había constituido el convenio. El plano catastrado se confecciona haciendo coincidir la realidad material con la catastral. Aunado a lo anterior, en la certificación registral de esa finca de la actora (imagen
  • 2)se refiere que al este colinda con servidumbre de paso y José Ángel Prado, lo que refuerza la existencia de ese convenio. Pero resulta que esos tres indicios no son válidos para arribar a la conclusión de que sí existió un convenio verbal de constitución de servidumbre, convenio que no describe longitud, ancho y rumbo de la servidumbre y si esta fue gratuita y onerosa, por tiempo definido o indefinido, voluntaria o forzosa. La Sala Primera de la Corte Suprema de Justicia, en el Voto N° 002395-F-S1-2020 de las diez horas veinticinco minutos del ocho de octubre de dos mil veinte, dijo lo siguiente: "V. El recurso de casación presentado no logra el efecto pretendido y, por el contrario, es una gestión que deviene en inútil a fin de quebrar lo dispuesto en las sentencias de primera y segunda instancia. Lo anterior por cuanto, la parte no atacó en ningún momento la conclusión del personal juzgador, en el sentido de que la prueba aportada y que reclama como indebidamente valorada no es idónea para acreditar la existencia de la servidumbre de paso, esto, no en el sentido de la existencia material, sino de que registralmente se haya establecido una limitación sobre el fundo de la demandada en favor de los de las accionantes; toda vez que la prueba idónea para ello, no es más que aquella que demuestre la constitución de la servidumbre conforme a lo establecido en los numerales 370, 375 y 379 del Código Civil. La citada prueba, se echa de menos a lo largo de todo el proceso y es por esto que no es posible otorgar una restitución de la servidumbre conforme a lo pretendido, pues no se cuenta con el convenio o la disposición de última voluntad, en el que se indique las dimensiones, naturaleza y demás detalles de la misma. Como bien lo expuso el juez de primera instancia y reafirmaron las juezas de alzada, la servidumbre de paso no puede constituirse por el asentimiento o el simple uso y paciencia del propietario del fundo sirviente, toda vez que este tipo de servidumbre no cumple con las características que impone el citado artículo 379 del Código Civil; que es ser una servidumbre continúa y aparente a la vez, debido a que carece del primer requisito, esto, al requerir de una actividad humana cada vez que se utiliza. Ahora bien, respecto de la prueba documental aportada ante esta instancia, la misma no es de recibo; en primer lugar, porque no fue aportada en la forma que estipula el artículo 609 del Código Procesal Civil (utilizando para la resolución de este recurso la Ley 7130, conforme a lo establecido en el Transitorio I de la Ley 9342 y se armonizará en lo posible el procedimiento con la nueva legislación) y en segundo; porque no se trata de documentos de influencia efectiva para el proceso, ya que, al igual que la prueba que se alega indebidamente valorada, corresponde a documentos en los que se indica que la servidumbre es un límite de la propiedad, más no de constitución de tal." (la negrita y el subrayado no es del original). El artículo 375 del Código Civil que menciona dicho Voto, establece que la extensión de las servidumbres se determina por el título, documento necesario del que carece la parte demandada para probar dicho convenio y sostener la Tesis del A quo.Por otro lado, La Sala Primera de la Corte Suprema de Justicia, en el Voto N°001583-F-S1-2019 de las once horas cuarenta y dos minutos del veinticuatro de julio de dos mil diecinueve, dijo lo siguiente: "V. En sus dos primeras líneas de argumentos, conforme a la síntesis procurada en el III Considerando, la recurrente rechaza la falta de prueba de la servidumbre pues, en su tesis, las segregaciones originales de sus fincas la demuestran mediante los linderos descritos en la segregación de su propiedad 98090. Al mismo tiempo reprocha error en las segregaciones que dieron lugar a las fincas de los accionados luego de 1998, pues hacen “aparecer” una servidumbre en contra de su propiedad no. 90038 que en realidad no existe. Sobre este último punto cabe recordar que el Tribunal rechazó la reconvención pues, entre otras razones, consideró que en el área objeto de disputa tampoco está constituida una servidumbre en beneficio de los predios de los demandados, por lo cual ese último punto carece de interés, en tanto no entraña ningún pronunciamiento a favor o en contra de las pretensiones de alguna de las partes litigantes. En torno al primer aspecto, como bien refiere el Tribunal, para tener por constituido el derecho real de servidumbre, particularmente en las de carácter discontinuo -como ocurre con la servidumbre de paso-, se requiere de acuerdo de partes, o disposición de última voluntad (artículo 379 del Código Civil). La actora insiste en demostrar la existencia de la servidumbre (en el área disputada) a partir de la descripción de linderos de las sucesivas heredades que derivaron de las fincas 20900 y 76048. Tal esfuerzo es insuficiente, pues la descripción que haga el topógrafo de las colindancias de una finca -replicadas por el notario para la respectiva inscripción del terreno a partir de la información brindada por el agrimensor- no equivale a constitución de derecho real alguno respecto de las colindancias, su estatus o calificación jurídica. Se requería de acreditación de un negocio jurídico o disposición testamentaria -se insiste- en el que la parte actora, o anteriores titulares de las fincas 90038-000 y 98090-000 establecieran ese derecho real en beneficio de esa última heredad. Lo anterior evidencia la imposibilidad de acoger su reclamo de titularidad sobre la servidumbre y la negación de ésta respecto de los fundos de los demandados, en tanto, se reitera, no está inscrita una servidumbre en el área objeto de debate, ni a favor de la actora ni de los accionados. Así, sus dos primeras líneas de argumentos deben denegarse. (la negrita y el subrayado no son del original). Para los que hemos tramitado planos catastrados en los últimos años, sabemos que todo topógrafo que tenga conocimiento de que si un camino interno le da salida a otra finca del fondo, ellos la grafican como servidumbre de paso o servidumbre agrícola, y la grafican con 7 metros de ancho, aunque en la materialidad no los tenga, y esto lo digo por conocimiento de causo tanto por experiencia propia como por casos judiciales que he conocido en donde los dueños de fundos me informan de que a pesar de ellos rogarles o insistirles a los topógrafos que grafiquen el camino como un camino interno, estos insisten en graficarlas con el nombre de servidumbres agrícolas o de paso. SEGUNDO MOTIVO: ERRÓR DE ANÁLISIS Y/O APLICACIÓN DE LA LEGISLACIÓN SUSTANTIVA: El A quo analiza y aplica erróneamente el artículo 1008 del Código Civil el cual establece: “El consentimiento de las partes debe ser libre y claramente manifestado. La manifestación puede ser hecha de palabra, por escrito o por hechos de que necesariamente se deduzca”. La inconformidad se logra verificar cuando el A quo dice en lo literal en la sentencia recurrida: “Sobre el particular, lleva razón la parte accionada, cuando argumenta en su contestación que debe de aplicarse en este caso el ordinal 1008 del Código Civil el cual establece: "El consentimiento de las partes debe ser libre y claramente manifestado. La manifestación puede ser hecha de palabra, por escrito o por hechos de que necesariamente se deduzca" (el énfasis no es del original). Ello por cuanto la prueba del convenio que refiere el ordinal 379 de ese mismo cuerpo legal, debe de valorarse conforme a las circunstancias del caso en particularmente el artículo 54 de la Ley de Jurisdicción Agraria. Por ello no resulta atendible el argumento de la parte actora de que no se aportó "convenio escrito" porque no rige un sistema de prueba tasada para acreditar esta circunstancia. Bajo esta inteligencia, de esas declaraciones se desprende que evidentemente había un convenio o voluntad del titular del fundo sirviente (de Pedro Prado) para que el camino existente en su finca se destinara a servidumbre de la finca de su hermano (José Ángel), quien incluso lo mejoró hace más de veinte años.” En cuanto a lo dicho por el A quo en la sentencia, la parte actora considera que no lleva razón la jueza por los siguientes dos motivos: 1) La jurisprudencia nacional en cuanto a constitución de servidumbres de paso se ha decantado mayoritariamente por los convenios escritos y no verbales para demostrar su constitución, y 2) El mismo artículo 1008 del Código Civil dice al inicio: “El consentimiento de las partes debe ser libre y claramente manifestado…” y de la prueba aportada por las partes y los indicios invocados por el A quo no se logra determinar con claridad la información necesaria para inscribir una servidumbre como la longitud, ancho y rumbo; y si esta fue onerosa o gratuita, por tiempo definido o tiempo indefinido. Los testigos de la parte demandada solo se refirieron al uso por mera tolerancia, nunca afirmaron de que hubieran estado presentes cuando se dio el pacto verbal de constitución de servidumbre definiendo la descripción clara de los elementos constitutivos que si se dan en un verdadero convenio. Si bien los convenios pueden ser verbales, estos deben probarse fehacientemente, como podría ser las declaraciones de los ex – propietarios de los fundos sirviente y dominante, las declaraciones de testigos que respalden el negocio jurídico de constitución de servidumbre y no la simple materialidad de un camino y el análisis de indicios indirectos, que ya la jurisprudencia ha manifestado son insuficientes para declarar como constituida una servidumbre de paso. En este sentido, La Sala Primera de la Corte Suprema de Justicia, en el Voto N° 000750-F-2000 de las dieciséis horas treinta minutos del dos de octubre de dos mil, dijo lo siguiente: “IV. La codemandada aquí recurrente sostiene que la servidumbre se constituyó por acuerdo de voluntades entre el actor y la anterior propietaria del inmueble. El actor, por su parte, si bien admite que el tendido eléctrico se dispuso con su anuencia, niega que el permiso trascendiera de una cuestión meramente personal, esto es, una concesión gratuita en provecho exclusivo de un pariente. La constitución de una servidumbre, como se vio, importa un gravamen real sobre un inmueble y por lo mismo una limitación muy grave del dominio. Por eso, si procede de convenio, debe tener como sustento un acuerdo claro y expreso. No se puede inferir de actos o conductas de contenido ambiguo. Según resulta de la prueba analizada por los juzgadores, fundamentalmente la testimonial, hay elementos de juicio suficientemente explícitos y además coincidentes para concluir que el permiso de reiterada mención se dio intui personae.” (la negrita y el subrayado no son del original). TERCER MOTIVO. TRANSCRIPCIÓN PARCIAL Y MUTILACIÓN DE LA PRUEBA. Vemos con tristeza que se transcribe mucho los testimonios de la parte demandada (demandados y testigos) y se mutila prueba importante a nuestro parecer de la parte actora, como lo es la descripción detallada de las perturbaciones, el hecho de que en una de las casas que está al lado de la supuesta servidumbre viven allí la madre de la actora, doña Olga Chinchilla Arias, actualmente de 85 años de edad (que es la testigo de más edad y no el señor Noe Eduardo Elizondo Arias como se dice en la sentencia), y también su hermano mayor, Dagoberto Prado Chinchilla, actualmente de 62 años de edad y quien tiene una afección cardiaca; ambos fueron testigos del proceso, pero solo se mencionan partes de sus testimonios, solamente para favorecer la tesis desarrollada por el A quo. Pido vehementemente al Tribunal de Alzada escuchar los audios de los testimonios de los testigos y declaración de parte de la parte actora. Por ejemplo, la declaración de la testigo dra. Cristina Prado no fue tomado en cuenta ni mencionado para nada. Por otra parte, El A quo toma como cierto todo lo que dijeron los testigos de la parte demandada. Por ejemplo, el padre del demandado Carlos Rodolfo Mora Solano, el señor Aurelio Mora Cruz manifestó en forma maliciosa y para favorecer a su hijo, que los terrenos de los hermanos Pedro y José Ángel ambos Prado Segura, los obtuvieron por herencia de su padre, lo cual es falso. Por ejemplo, la finca con folio real 139456-000 el señor Pedro Prado Segura, padre de la actora Ana Isabel Prado Chinchilla, la obtuvo por medio de compra que le hiciera al señor Claudio Fallas García el día 11 de agosto del año 1956, esto ante el Notario Carlos Bolaños Morales, certificación que se aporta como prueba para mejor proveer. Nótese que esta finca folio real SJ-139456-000 medía 10 hectáreas, 26 áreas, 88 centiáreas, 76 decímetros cuadrados por lo que desmiente lo dicho por el testigo complaciente Aurelio Mora Cruz. Cuando don Pedro Prado, padre de la actora Ana Isabel Prado, compra la finca descrita en el 11 de agosto del año 1956, el señor Aurelio Mora Cruz, padre del demandado Carlos Rodolfo Mora Solano, no había nacido siquiera, ya que don Aurelio actualmente de 66 años de edad, nació el 13 de noviembre de 1956 (de acuerdo al Registro Civil). El testigo de la parte demandada Noe Eduardo Elizondo Arias tenía apenas 10 años de edad en el año 1956 y no era ni vecino cercano del lugar, solo visitaba el caserío de Cangrejal ocasionalmente como él lo dice en su declaración. Solicito se tenga duda de lo declarado por los testigos de la parte demandada señores Aurelio Mora Cruz y Noe Eduardo Elizondo Arias. CUARTO MOTIVO. INCONFORMIDAD POR NO DAR MÉRITO A LA PERTURBACIÓN Y ARROGACIÓN DE UN DERECHO REAL POR PARTE DEL DEMANDADO CARLOS RODOLFO MORA SOLANO: El A quo minimiza en este caso dos elementos importantes de la acción negatoria como lo son la perturbación y la arrogación de un derecho real por parte de los demandados. Esto se logra verificar en el considerando VII en donde la Jueza le resta importancia a las perturbaciones realizadas por los demandados (moto tours y peleas de gallos), cuando la perturbación es uno de los elementos detonadores de toda acción negatoria así como el hecho de que los demandados se arroguen un derecho no constituido como es la servidumbre de paso. Ulate dice: “Se trata de un medio de defensa contra la inquietación o intromisión en la propiedad ajena, cometida sobre la base de atribuirse un derecho” (Ulate Chacón Enrique. Manual de Derecho Agrario y Justicia Agraria. San José, Calbasa; 2007, pag.713). El hecho de que la familia Prado Chinchilla le haya permitido el paso por mera tolerancia a la familia Prado Monge por 50 años, esto por ser familia, eso no significa que un tercero ajeno a la familia venga a comprar un derecho y se le tenga que permitir actividades como moto tours y actividades de peleas de gallos, en donde un tropel de vehículos automotores y gente pasen por medio de la finca de la actora, en donde vive su madre que es una adulta mayor y también vive su hermano mayor que tiene una afección cardiaca y necesitan tranquilidad y paz en sus vidas."

VII.Conviene exponer, en primer término, los elementos que componen una acción negatoria, de la cual se trata el presente asunto, según se desprende del compendio de pretensiones contenidas en el libelo de demanda visible a folio 58. Dicha acción, contenida dentro del amplio espectro, contenido en nuestro Ordenamiento Jurídico para la tutela de la propiedad y contenido en el Voto de este Tribunal de las 14:45 horas del 17 de agosto de 1997, No. 586, citando a la Sala Primera de Casación, en lo conducente indicó: "...IV.- La Jurisprudencia de la Sala Primera de Casación, ha reiterado en muchas sentencias lo relativo a las distintas acciones protectoras del derecho de propiedad. Entre otras, en la sentencia No. 230 de las 16 horas del 20 de julio de 1990, se expresó: "IV.- Nuestro ordenamiento jurídico tiene un amplio espectro para la tutela de la propiedad en sus más diversas manifestaciones, podría señalarse que no obstante encontrarse dispersas por diferentes partes del Código Civil, incluso de otros cuerpos normativos, hay todo un régimen de acciones protectoras (artículos 295 y 316 del Código Civil), divididas en dos grandes apartados: 1) Las acciones de hecho, contempladas en los artículos 305 y 306 del Código Civil referidas a la autorización otorgada al propietario para defender de hecho su derecho cuando el mismo se encuentra amenazado, sólo que en este caso su acción resulta jurídicamente tutelada en tanto ejerce la protección con las particularidades propias de la legítima defensa, es decir frente a la agresión ilegítima, siendo necesaria su defensa, y existiendo proporcionalidad en el medio empleado. 2) Existen también un complejo conjunto de acciones de derecho aplicadas según el caso a las exigencias del propietario, el derecho afectado, e incluso la urgencia en su uso.

Estas acciones muchas veces tienen una estructura formal similar (en cuanto al propietario, a quien afecta, perturbar o despoja la propiedad, y sobre todo en cuanto a la correcta identificación de la cosa), sin embargo, tienen grandes diferencias en cuanto a la forma en que tutelan la propiedad. Estas acciones pueden dividirse de la siguiente forma: A) acciones ordinarias, ubicándose dentro de esta categoría a) la acción reivindicatoria (artículos 316, 320 a 333 del Código Civil), b) la Negatoria, referida a la afectación de otro de los atributos de la propiedad distinto del de posesión, y es la denominada actio negatoria del Derecho romano, y c) la publiciana, denominada en Costa Rica más comúnmente como de mejor derecho de posesión (artículos 317 y 322 del Código Civil)... V.- LAS ACCIONES PROTECTORAS DE LA PROPIEDAD ( COMO DERECHO REAL) EN VIA ORDINARIA: Estas acciones mantienen un parelelismo respecto a las acciones protectoras de otros derechos reales, tales como la posesión, el usufructo y la servidumbre, las cuales adquieren otras denominaciones, dependiendo del fin perseguido.

Veamos: 1. Para recuperar la posesión el titular del Derecho de propiedad, cuenta con la acción reivindicatoria, mientras que quien ostenta el Derecho de posesión pero por haber sido desposeído cuenta con la conocida "acción publiciana" o de mejor derecho de posesión; 2. También, cuando el propietario no pretende recuperar la posesión pero si obtener la declaratoria de su derecho con efectos erga ommes cuenta con la ACCION DECLARATIVA O DE CERTEZA; 3. Igualmente puede negar el derecho real de otra persona que se lo atribuye para sí, conocida como ACCION NEGATORIA. Estas dos últimas, es lógico pensar que también son procedentes en tratándose del Derecho de posesión como derecho real que necesita ser protegido, así el poseedor que se ve perturbado en su Derecho de posesión ( ya no en la posesión como mero hecho caso en el cual podría ejercitar la acción interdictal), puede pedir en vía ordinaria que se declare que es a él a quien le asiste el derecho, y también negar a otra persona un derecho que se está atribuyendo indebidamente y que no le pertenece ( ACCION DECLARATIVA Y NEGATORIA)...

VIII.- LA ACCION NEGATORIA: La acción NEGATORIA es también una acción real que puede ser ejercitada tanto por un propietario, como por quien ostenta legítimamente otro derecho real. "La acción negatoria asiste al propietario para obtener la declaración de que la cosa objeto de su derecho no se encuentra sujeta al derecho que otro se atribuye sobre ella. Se llama negatoria o de libertad de la propiedad y puede ejercitarla todo propietario, poseedor o no, exclusivo o copropietario, tanto de bienes muebles como de bienes inmuebles... Se trata de un medio de defensa contra la inquietación o intromisión en la propiedad ajena, cometida sobre la base de atribuirse un derecho... La acción no aparece expresamente regulada por el Código Civil, pero ha sido reconocida y regulada en su ejercicio por la jurisprudencia del Tribunal Supremo. Sus requisitos de ejercicio sería fundamentalmente, los siguientes: 1.

La justificación del dominio actual del actor. 2. La prueba de los actos de perturbación que el demandado ha causado en el goce o ejercicio del dominio. Esta perturbación tiene que haber sido realizada con la pretensión de ostentar un derecho real sobre la cosa, puesto que para reprimir perturbaciones de mero hecho puede utilizarse las acciones posesorias.... La acción negatoria produce, fundamentalmente, los siguientes efectos de una parte, la declaración de que no existe el pretendido derecho del demandado; por otra parte, lo indemnización de daños y perjuicios que hay que unir a la cesación de la perturbación." ( Ver MONTES, op. cit., páginas 106-108).- También se ha definido la acción negatoria de la siguiente forma: la que compete los poseedores de inmuebles contra quienes les impidan el libre ejercicio de los derechos reales, a fin de que esa libertad sea restablecida. ( Artículo 2.800 del Código Civil Argentino).

Esta acción se da contra cualquiera que perturbar el derecho de poseer de otro, aunque sea el dueño del inmueble, cuando se arrogue sobre él una servidumbre indebida... ( Ver CABANELLAS, Guillermo. Diccionario de Derecho Usual, op, cit, Tomo I, página 48). En principio, y a partir de las fuentes romanas, la acción negatoria era concedida básicamente al propietario quien, al verse inquietado o perturbado por un sujeto que se atribuía para sí un derecho de usufructo o servidumbre, solicita declarar la inexistencia de tal derecho. Refiriéndose a dichas fuentes romanas, la doctrina española cita los siguientes casos de acción negatoria: " Es ésta la acción propia del dueño de un fundo contra una persona que pretende tener un usufructo sobre el mismo cuando el propietario niega la existencia de este usufructo". "Es ésta la acción correspondiente al propietario de un fundo contra la persona que injustamente pretende tener un derecho de paso a través del mismo." "Es ésta la acción del propietario de un fundo contra la persona que pretende tener derecho a construir un edificio sobre su propio suelo, elevándolo más de cierta altura, cuando el actor niega que tenga tal derecho".(MARTIN-BALLESTERO, Luis.

La acción negatoria, Editorial Tecnos, Madrid, 1993, p. 43). Desde esa perspectiva, estaba legitimado para ejercer la acción negatoria únicamente el propietario. El legitimado pasivamente podía ser no solo contra aquellos que pretendieren mantener una posible servidumbre, sino que bastaba con la existencia de un estado o situación de hecho que objetivamente se correspondiera con el ejercicio de una servidumbre o usufructo. De esa forma era una acción limitada. La doctrina tradicional exigía como requisitos de la acción negatoria los siguientes: "1. que el actor justifique en principio su derecho de propiedad (mediante la presentación del correspondiente título de adquisición de la cosa). 2. Que pruebe la perturbación que el demandado le haya causado en el goce de su propiedad (perturbación que ha de ser realizada con pretensión de ostentar un derecho real, pues para reprimir perturbaciones de puro hecho no hace falta acudir a esta acción).

En cambio, no es preciso que pruebe el actor la inexistencia de la servidumbre o derecho real pretendidos por el tercero, pues es principio de derecho ya repetido que la propiedad se presume libre y que el que sostiene la existencia de limitaciones a la misma es quien debe probarlas".(CASTAN TOBEÑAS, Derecho Civil español, común y foral, ed. rev. por G. García Cantero, 2, vol. 1o., Reus, Madrid, 1992, p. 216, citado por Martin-Ballestero, op.cit., p. 80). IX.- Modernamente la acción negatoria tiene otro perfil práctico. No es solo para la defensa del derecho de propiedad. Debe admitirse que titulares de otros derechos reales sobre la cosa tengan protección contra quienes ejerzan sobre aquélla supuestos derechos que les perjudiquen. Indudablemente merecen una protección por parte del ordenamiento, independientemente de que se le llame acción negatoria o de otro tipo. En la doctrina española, se admite hoy día la posibilidad de ejercitar la acción negatoria, no solo frente a actos perturbatorios derivados de un presunto ejercicio de un derecho real de servidumbre o usufructo, sino también cuando la perturbación o molestia lo es de puro hecho o alegando haber adquirido mediante un documento privado un derecho que ahora el titular le niega. En este caso estaríamos ante un supuesto de acción negatoria puramente declarativa..." (Lo resaltado no corresponde al original).-

VIII.Conviene, asimismo, analizar la figura de la servidumbre de destino de padre de familia, alegada por la parte demandada y negada por la parte actora a lo largo del proceso, la cual es una servidumbre cuyo origen es legal y de la cual, en el voto 113-F-09 de este tribunal sobre el tema de las servidumbres se ha resuelto: " V.- ...Pretende obtener la declaración judicial de una servidumbre de paso a su favor, sin indemnización, por considerar que su inmueble conformaba una sola finca, con el terreno de los demandados, y desde tiempos inmemoriales ha utilizado el paso, sobre dichas fincas, para poder salir a la calle pública de Las Palmas. Además, sostiene, que la quebrada existente detrás de su casa, llamada Quebrada Las Palmas, afluente del Río Sucio, imposibilita el paso o salida a la calle pública que colinda al norte y al oeste con su propiedad, lo cual le afecta porque tiene su esposa enferma.

Recrimina que los demandados le cerraron el paso, irrespetando ese derecho de paso existente y dejándolo sin posibilidad material de salir cómodamente de su propiedad y sin salida bastante a la vía pública, (folios 428 a 434). Todo ello, nos lleva a reflexionar sobre la naturaleza de la servidumbre de paso, y sus distintas formas de constitución reconocidas por nuestro ordenamiento jurídico, que tiene una derivación francesa. VI.- Este Tribunal, desde hace más de diez años, explicó en una resolución las diferentes formas de dar solución a un caso como el presente, al respecto señaló: "...Uno de los aspectos esenciales en relación con las servidumbres, es lo relacionado a su contenido y a su modo de constitución, siendo este tema esencial para la resolución del fondo de este asunto. Cuando un fundo, quede en una situación de enclave, y por ende no tenga salida o salida bastante a calle pública, el ordenamiento jurídico ha configurado varias soluciones posibles, dependiendo de las situaciones fácticas, por las cuales se originó el enclave.

La primera solución posible en relación a un predio enclavado, es que la salida suficiente a calle se le otorgue por medio de la constitución de una servidumbre, voluntaria. Sobre las servidumbres voluntarias, Manuel Albaladejo señala: "Las servidumbres se establecen: 1. Por voluntad de los interesados, mediante negocio jurídico mortis causa o intervivos (...) Para constituirlas es preciso tener capacidad para disponer por el acto de que se trate del bien sobre el que se establecen, y que correspondan al constituyente las facultades que la servidumbre que sea otorgada sobre la cosa gravada. Por eso es indudable que puede constituirlo el dueño pleno (o si aquella es de varios, obrando todos por unanimidad); en cuanto al propietario nudo o con dominio limitado por algún otro derecho (así, por servidumbre anterior existente sobre la cosa, o si, de cualquier modo los deja a salvo, y en cuanto a quién, sin ser propietario, tiene sobre la cosa un derecho que le atribuye las facultades que la servidumbre conferirá al dueño dominante, puede también constituir ésta (como las mismas sortapisas señaladas antes para el dueño con dominio limitado) para el tiempo que dure su derecho".

Esta posibilidad de constituir servidumbre por voluntad, ya sea mortis causa o intervivos, se encuentra regulada en el Código Civil, en la relación de los artículos 378 y 379, por cuanto el primero señala: "Las servidumbres que son continuas y aparentes a la vez, pueden constituirse por convenio, por última voluntad o por el simple uso del uno y paciencia del otro", y en el segundo artículo indica: "Las servidumbres discontinuas de toda clase y las continuas no aparentes, solo pueden constituirse por convenio o por última voluntad. La posesión aún la inmemorial, no basta para establecerlas." Otro de los modos por los cuales se puede dar solución al problema del fundo enclavado, es el supuesto indicado en el artículo 380 del Código Civil el cual señala: "La existencia de un signo aparente de servidumbre continúa entre dos predios, establecido por el propietario de ambos, basta para que la servidumbre continúe activa o pasivamente, a no ser que al tiempo de separarse la propiedad de los dos predios, se exprese lo contrario en el título de la enajenación de cualquiera de ellos".

Esta figura es la denominada servidumbre por "destino de padre de familia" que "consiste en que si existe un signo aparente de servidumbre entre dos fincas establecido por el propietario de ambas, se considerará, si se enajenare una, como título para que la servidumbre surja" (ALBALADEJO, Manuel. Derecho Civil, Tomo III, Vol. II, Editorial Bosch, 8a. edición, 1994, pág. 141). En consecuencia, al existir una servidumbre, es evidente que el actor tiene derecho a hacer uso de las facultades que la Ley le confiere para su ejercicio. En efecto, el artículo 374 del Código Civil dispone: "El que tiene derecho a una servidumbre, lo tiene igualmente a los medios necesarios para ejercerla, y puede hacer todas las obras indispensables para ese objeto, pero a su costa, si no se ha estipulado lo contrario...". La servidumbre por destino de padre de familia, debe cumplir una serie de requisitos, que de buena forma expone Albaladejo citando a Bonet Correa, en lo que interesa: "La creación de la servidumbre se produce ex lege (...) por la concurrencia de los requisitos que la ley marca con independencia, pues, de que los signos de la misma no se hayan suprimido por inadvertencia o para que, mantenidos, surgiere aquella; y los mismo que diga que si es que la escritura no contenía declaración contra la servidumbre.

El signo debe ser viable (...) no importa que la servidumbre que se crea sea precisa. (...) el signo aparente de servidumbre dice la ley que haya sido "establecido por el propietario de ambas" (....) Pero el término "establecer" no debe interpretarse estrechamente, así que entendemos vale también el signo puesto por otro, y conservado por el propietario. Lo que importa es que exista al producirse la enajenación de la finca. (...) La servidumbre no surge si al tiempo de separarse la propiedad de las dos fincas se expresa lo contrario en el título de enajenación de cualquiera de ellas (...) De donde se sigue que si se enajena sólo será en el título de enajenación de ésta donde deberá hacerse constar la voluntad contraria, y si se enajenan las dos simultáneamente, podrá hacerse constar en el de cualquiera de ellas. (...) Por título se entiende la escritura correspondiente." (ALBALADEJO, Manuel, Derecho Civil, Tomo III, Vol. II, Editorial Bosch, 8ª. edición, 1994, pág. 141-143).

Es claro que bajo este supuesto no corresponde la indemnización, por cuanto la servidumbre existía y ha sido utilizada para dichos efectos desde que se originó el fundo que quedó teóricamente enclavado, pero que en la realidad tenía salida constituida por el antiguo dueño. De aquí que se derive la consecuencia de la no indemnización pues la salida fue adquirida de pleno derecho sea ipso iure, sin necesidad de declaratoria judicial. La tercera posibilidad para darle salida al fundo enclavado, es la servidumbre constituida de forma forzosa, el Código Civil al respecto señala en su artículo 395: "El propietario de un predio enclavado entre otros fundos, sin salida o sin salida bastante a la vía pública, tiene derecho de exigir paso por los predios vecinos para la explotación del suyo, pagando el valor del terreno necesario y de todo otro perjuicio". Sobre este tipo de servidumbre forzosa Albaladejo señala: "Por disposición de la autoridad (judicial o administrativa) es decir, por adjudicación que ésta decreta a favor del titular.

Lo que ocurre en el caso de las prediales forzosas (...) cuando pedida su constitución por quien tiene derecho a la misma, es otorgada por la autoridad competente" (ALBALADEJO, Manuel, Derecho Civil, tomo III, Vol. II, Editorial Bosch, 8a. edición, 1994, pág. 141-143). Esta forma de constitución, tiene como particularidad el hecho de que se constituye por medio de declaratoria judicial y debe indemnizarse el valor del terreno necesario y todo otro perjuicio. Finalmente, el problema de un predio enclavado, puede ser solucionado por medio del instituto del derecho de paso regulado en el artículo 400 del Código Civil, el cual indica: "Si se vende o permuta alguna parte de un predio, o si se adjudica cualquiera de los que lo poseían en común, y esa parte queda enclavada, se considerará concedido a su favor el derecho de paso sin indemnización alguna". Este artículo presenta la particularidad de que el fundo queda enclavado a raíz de un acto dispositivo del titular del predio, de modo tal de que transmite parte del inmueble dejando una de las partes enclavada, en consecuencia por razones de interés social y económica de que todo el fundo tenga salida a calle, se entiende que todo fundo tenga salida a calle, se entiende que de pleno derecho el sujeto tenga derecho de paso, para así tener salida a calle, sin que se le pueda obligar a pagar indemnización alguna por ello.

En síntesis, de las anteriores argumentaciones se han podido establecer cuatro diversas soluciones frente a un problema de fundo enclavado..." (Tribunal Agrario, No. 635 de las 13:45 horas del 24 de setiembre de 1999). VII.- Dadas las particularidades del caso que nos ocupa, en donde la supuesta servidumbre de paso reclamada por el actor, podría provenir de un fundo que originalmente pertenecía al mismo propietario, conviene profundizar sobre la naturaleza de la servidumbre por destino de padre de familia, con el fin de determinar, si dicho instituto es aplicable únicamente a las servidumbres continuas o aparentes, como sostiene una parte de la doctrina, o también puede ser aplicado a las servidumbres discontinuas, como sería la de paso, cuando exista un signo aparente de servidumbre y la misma no haya sido rechazada al momento de producirse el traspaso o la escritura. Si sobre los orígenes del artículo 380 de nuestro Código Civil, habría que referirse, en primer lugar, a la experiencia francesa, en donde el legislador, la doctrina y la jurisprudencia, han coincidido en darle un alcance amplio a la servidumbre por destino de padre de familia, reconociendo su aplicación también para los casos de las servidumbres de paso donde pueda existir un signo aparente de servidumbre.

Los artículos 692, 693 y 694 del Código Civil francés disponen: "692.- El destino del padre de familia vale como titulo respecto a las servidumbres continuas y aparentes" “693.- Existirá destino de padre de familia siempre que esté probado que los dos fundos actualmente divididos han pertenecido a un mismo propietario, y que es por él que las cosas han sido puestas en el estado del cual resulte la servidumbre". " 694.- Si el propietario de dos heredades entre las cuales existe un signo aparente de servidumbre, dispone de una de las heredades sin que el contrato contenga alguna cláusula relativa a la servidumbre, ella continúa existiendo activamente o pasivamente en favor del fundo enajenado o sobre el fundo enajenado". En relación con la división y la valoración de la prueba, la jurisprudencia francesa ha establecido criterios sobre la existencia del signo aparente de la siguiente forma: "La prueba de una servidumbre de paso establecida por destino de padre de familia, resulta, dentro del silencio del acto que ha operado la separación de las dos heredades, de la existencia de un signo aparente de servidumbre".

(Req. 6 déc. 1898, D.P. 99, I, 87.- Civ. 8 juill. 1919, D.P. 1923.1.230, en: Códe Civil, Dalloz, Paris, 1965, p. 311) "Los jueces de fondo aprecian soberanamente la existencia, después de la división de las heredades, operada por el autor común, de un signo aparente de servidumbre establecido por destinación de padre de familia, y si es determinante después la intención del constituyente y las circunstancias extrínsecas y de la ejecución dada a los actos o convenciones e igualmente toman en consideración los elementos posteriores a la división de los fundos" (Civ. 3e. 25 janv. 1972: Bull.civ.III, no. 54 23 janv. 1991: ibid. III, no 38.- Jurisprudence constante). En la ausencia de signos aparentes sobre el plano anexo al acto de venta, esos signos aparentes deben ser buscados dentro de la situación misma del lugar (Civ.3e, 11 juin 1992: bull.civ.III, no. 201). El estado de hecho aparente, característico de la servidumbre por destino de padre de familia, debe existir al momento de la división de los fundos (Soc. 27 déc. 1945: D. 1946).

Code Civil, 101º edición, Dalloz, 2002, página 650. La doctrina francesa, hace referencia a una controversia secular con motivo de la interpretación de ambas disposiciones (Bonecasse, Tratado Elemental de Derecho Civil, Harla, 1990, p. 498). Como elementos constitutivos de la servidumbre, según el 693, señalan tres: "1. Se requiere que las dos fincas, actualmente separadas, hayan pertenecido con anterioridad al mismo propietario; 2. Que se demuestre que este propietario es el autor del estado actual de los predios, que creó ese estado de hecho, del cual, con posterioridad surge la servidumbre que nunca antes había existido; y 3. Que este estado de hecho sea permanente, constitutivo de servidumbre y no un simple acondicionamiento para la comodidad" (PLANIOL Y RIPERT, Derecho Civil, 1990, Harla, p. 546). En relación a la interpretación del 694 los citados autores afirman: "el art. 694 se conforma con un signo aparente de servidumbre.

No es necesario que la servidumbre sea continua. ¿Podrá aplicarse el art. 694 a una servidumbre de paso, la cual no es susceptible de constituirse por destino del padre de familia, ya que es discontinua?... En nuestra opinión, la distinción debe ser la siguiente: el art. 692 se ocupa de la creación de una servidumbre nueva, por destino de padre de familia, la cual nunca había existido con anterioridad; nace primero de hecho, antes de hacer como servidumbre al separarse los dos predios. El art. 694 se ocupa de los casos en que una servidumbre, establecida por cualquier procedimiento, existía ya entre dos predios que con posterioridad pertenecen a la misma persona. La servidumbre se extinguió, en este caso, por confusión, y lo que se trata de saber es en qué condiciones revivirá cuando las dos fincas se separen nuevamente. Continúa existiendo, dice el texto, lo que es una expresión muy exacta; se verá que la confusión no implica ningún obstáculo temporal al ejercicio de la servidumbre, y que, en realidad, no la extingue.

La ley se conforma con un signo aparente de servidumbre, es decir, un indicio que anuncie la intención de mantener el estado de hecho anterior. La ley da, más facilidades para mantener una servidumbre que para crearla, no exige la condición de continuidad. De esta manera el tribuno Albison explicó el art. 694..." (PLANIOL y RIPERT, op. cit., p. 546). La doctrina francesa más moderna, se refiere a esta antigua controversia, sobre las servidumbres, cuando son aparentes pero discontinuas, como la servidumbre de paso, cuando se ha trazado un itinerario para su ejercicio, indicando que esa jurisprudencia ha sido aprobada por la mayoría de autores: "La jurisprudencia francesa adopta una solución más conforme al sentido literal de los artículos 692 y 694 y a las tradiciones de las costumbres de París y de Orléans. Sus razonamientos proceden del fundamento de la creación de la servidumbre por destino de padre de familia, creación que reposa sobre la voluntad presunta de las partes que, luego del acto de separación, han dejado subsistir el estado de cosas anterior." (TERRÉ, Francois y SIMLER, Philippe, Droit civil.

Les biens, 5a. edición, París, Dalloz, 1998, p. 677). De todo lo anterior, se concluye, que la servidumbre por destino de padre de familia se aplica, en principio a las servidumbres aparentes y continuas. Sin embargo, la existencia de un signo aparente de servidumbre, cuando un propietario lo establece para el mejor ejercicio de su actividad, entre dos fundos o uno solo de su propiedad, y luego se divide en partes, dicho acondicionamiento que ha creado por comodidad y utilidad de su propio fundo, se mantiene, a favor o a cargo de los fundos resultantes de la división. Por ello, también resulta aplicable el instituto a las servidumbres de paso. Para una mejor comprensión del tema, y a fin de reforzar este criterio de interpretación, es importante analizar la regulación del instituto en otros países y el análisis que hace la doctrina dominante. El Código Español recogió el instituto en el artículo 541: "La existencia de un signo aparente de servidumbre entre dos fincas, establecido por el propietario de ambas, se considerará, si se enajenare una, como título para que la servidumbre continúe activa y pasivamente, a no ser que, al tiempo de separarse la propiedad de las dos fincas, se exprese lo contrario en el título de enajenación de cualquiera de ellas, o se haga desaparecer aquel signo antes del otorgamiento de la escritura".

La doctrina española, al interpretar los alcances de la norma indica: "El art. en cuestión es aplicable a cualesquiera servidumbre, con tal de que sean aparentes: así, pues, lo mismo sin son continuas que discontinuas (sentencias de 10 octubre 1957, 22 noviembre 1963, 11 junio 1975 y 7 julio 1983)...No importa que la servidumbre que se crea en virtud del art. 541 sea precisa. Así que también nace aunque ya haya otra para el mismo fin a favor del predio dominante. Por ejemplo, si hay signo aparente de la servidumbre de paso, esta surge aunque la finca beneficiada tenga ya a su favor otro acceso a camino público, bien por otra servidumbre, bien porque tenga directamente salida a aquél (sentencia de 10 octubre 1957 y 26 enero 1971). ALBALADEJO, Manuel. Derecho Civil, Tomo III, vol. II, 1994, p. 142). El mismo criterio aplica, según la doctrina, tratándose del caso de una copropiedad, donde es posible también que se constituya esa servidumbre por destino de padre de familia: "Si una o ambas de las fincas están en copropiedad y el signo lo establecieron todos los condueños o puesto por uno lo conservaron también los demás, no hay problema, y todo ocurre como en el supuesto de un solo dueño....En el caso de que lo hecho por un condueño dé lugar a servidumbre a favor del predio común, es decir, beneficie a la comunidad, parece que debe admitirse el nacimiento de la servidumbre..."(ALBALADEJO, Ibid.).

El Códice Civile Italiano, unificado de 1942, también recogió este instituto para las servidumbres aparentes en el artículo 1062, al permitir la adquisición de la servidumbre por "destinazione del padre di famiglia", que toma en cuenta el acto de destinación de un fundo al servicio de otro por parte del único propietario, refiriéndose a la voluntad de poner o dejar los fundos en un estado del cual resulte una apariencia de servidumbre. Se trata, en consecuencia de un mero acto o hecho jurídico, de destinación destinado a durar en el tiempo en forma inalterada hasta cuando se perfecciona el hecho de la separación de los fundos, que hace nacer la servidumbre si no existe una disposición en contrario. A falta de tal disposición, la servidumbre se constituye "ipso iure", al momento de la separación de los fundos, admitiendo cualquier tipo de prueba, incluyendo la testimonial, para demostrar su existencia ( BUSNELLI, y otros.

Diritto Civile, Diritti Reali, Utet, 1988, pág. 262). En consecuencia, la legislación, la doctrina y la jurisprudencia francesa, italiana y española, coinciden en reconocer la posibilidad de que se constituya una servidumbre por destino de padre de familia, cuando ésta provenga por un mismo dueño o por copropietarios de un mismo fundo, tratándose de una servidumbre de paso, y ésta presenta signos aparentes al momento de producirse la división del fundo, independientemente de que el fundo que resulte beneficiado tenga otra salida o acceso a calle pública. VIII.-Otros ordenamientos jurídicos latinoamericanos, incluyendo el nuestro, han adoptado y regulado la servidumbre por destino de padre de familia. Solo a manera de ejemplo, el Código Civil colombiano establece en el artículo 938: "Si el dueño de un predio establece un servicio continuo aparente en favor de otro predio que también le pertenece, y enajena después uno de ellos, o pasan a ser diversos dueños por partición, subsistirá el mismo servicio con el carácter de servidumbre entre los dos predios, a menos que en el título constitutivo de la enajenación o de la partición se haya establecido expresamente otra cosa".

El Código Civil boliviano, en su numeral 278 dispuso: "Cuando un propietario de dos fundos entre los cuales aparece un signo aparente de servidumbre, enajena uno de ellos sin ninguna disposición relativa a la servidumbre, ésta se entiende establecida activa o pasivamente en favor o en contra del fundo enajenado". El Código Civil venezolano, es más expreso y claro al establecer dentro de los modos de constitución de servidumbres en el artículo 721: "La destinación del padre de familia procede solamente respecto de las servidumbres aparentes, continuas o discontinuas y cuando consta, por cualquier género de prueba, que dos fundos actualmente divididos han sido poseídos por el mismo propietario, y que éste ha puesto o dejado las cosas en el estado del cual resulta la servidumbre...Si los dos predios dejan de pertenecer al mismo propietario, en uno cualquiera de los casos señalados en los dos párrafos anteriores, sin ninguna disposición relativa a servidumbre, ésta se reputa establecida activa o pasivamente sobre cada uno de dichos predios." IX.- Nuestro Código Civil, en su artículo 380 dispuso lo siguiente: "La existencia de un signo aparente de servidumbre continua entre dos predios, establecido por el propietario de ambos, basta para que la servidumbre continúe activa o pasivamente, a no ser que al tiempo de separarse la propiedad de los predios, se exprese lo contrario en el título de la enajenación de cualquiera de ellos".

Como en el código francés, dicha norma está ubicada con posterioridad a los artículos 378 y 379 del Código que regula la constitución de las servidumbres continuas y aparentes, así como las discontinuas y las continuas no aparentes, como reglas generales. En consecuencia la regulación del 380 es una excepción a las reglas anteriores. Del contenido literal de dicha disposición se desprende los siguientes requisitos: 1.- La existencia de un signo aparente de servidumbre entre dos predios. 2.- Que dichos predios pertenezcan al mismo propietario. 3.- Que ese signo aparente continúe activa o pasivamente. 4.- Que no exista una disposición en contrario al momento de la enajenación de cualquiera de ellos. Si se lee la expresión inicial completa donde habla de: "La existencia de un signo aparente de servidumbre continua entre dos predios...", de acuerdo a su formación histórica, debe interpretarse en el sentido de que ese signo aparente es continuo, antes y después de la enajenación del predio.

Es decir, que hay voluntad de mantenerlo, pues una de las formas de extinguirlo es eliminando el signo aparente existente, o bien, estableciendo expresamente en la escritura su desaparición. Esta interpretación debe ser la correcta, y así debe aplicarse para el caso en donde el signo aparente está referido a una servidumbre de paso. En efecto, la doctrina italiana, refiriéndose a sus orígenes vincula esta servidumbre, evocando las virtudes del campesino romano "sui iuris", que puesto a la cabeza de una hacienda rural, organiza y dirige las fuerzas de la naturaleza (Giorgianni, Buon padre di famiglia, Noviss. DI, II, 1958, 597, citado por BUSNELLI y otros, op. cit., página 263). Por lo que resulta admisible la constitución de este tipo de servidumbres por destino de padre de familia para las servidumbres de paso, como discontinuas y aparentes que son. Así lo ha reconocido la jurisprudencia de la Sala Primera de Casación de la Corte Suprema de Justicia en la sentencia No. 380-F-00 de las 16:45 minutos del 19 de mayo del 2000, en la cual se señaló a propósito de un caso concreto, similar al que nos ocupa, lo siguiente: "V.- Tocante al primer aspecto, el cual desemboca en la aplicación o no del artículo 380 del Código Civil y el deber de indemnizar, en caso de estarse ante la constitución de una servidumbre forzosa de paso, es menester apuntar lo siguiente.

Dicha norma preceptúa: “La existencia de un signo aparente de servidumbre continua entre dos predios, establecido por el propietario de ambos, basta para que la servidumbre continúe activa o pasivamente, a no ser que al tiempo de separarse la propiedad de los dos predios, se exprese lo contrario en el título de la enajenación de cualquiera de ellos.” (Lo resaltado no es del original). De conformidad con el tenor literal de ese artículo, uno de los requisitos indispensables para la procedencia de esta modalidad de constitución de servidumbre, es que los dos fundos pertenezcan a un solo propietario. De conformidad con la sustanciación, y las certificaciones aportadas con el recurso, se coincide con el casacionista cuando echa de menos tal requisito en el sub-júdice...Por otro lado, considera esta Sala, es cuestionable la existencia de signos aparentes de servidumbre al momento de hacerse la parcelación de tierras...Sea dicho trazo de líneas continuas que denotan la existencia de la servidumbre, no pasa por ese inmueble....

Por último, conforme lo ha resuelto reiteradamente esta Sala, la indemnización del valor del terreno y cualquier otro perjuicio, es un elemento inherente a la servidumbre forzosa. En relación, pueden consultarse, entre muchas otras, las sentencias números 80 de las 14:30 hrs. del 19 de julio de 1995; 17 de las 14:30 hrs. del 20 de enero; y, 129 de las 14:10 hrs. del 26 de marzo, ambas de 1999. Nuestro ordenamiento jurídico, al igual que otros, como el argentino, italiano y español, presenta una excepción a esa regla. Esta es, cuando el enclavamiento del fundo es producto de un negocio jurídico. En tales casos, se deberá constituir la servidumbre a favor del predio que en virtud del negocio haya quedado enclavado, sin indemnización alguna. Así lo dispone el artículo 400 del Código Civil. En la especie, según lo apuntado anteriormente, éste no es el caso, pues los fundos no pertenecieron nunca al mismo propietario.

Corolario de lo expuesto, en el sub-júdice no se está ante una servidumbre por destino de padre de familia, sino de una forzosa de paso, por tratarse de un fundo enclavado. Bastan las razones de hecho y de derecho expuestas para arribar a la conclusión dicha. Por ende, resulta innecesario reparar en otras alegaciones esgrimidas con esa finalidad. Además, al no configurarse el supuesto de excepción regulado en el Código Civil, procede reconocer, a favor de todos los propietarios demandados, cuyas fincas se verán afectadas por ese gravamen, el pago de la indemnización del valor del terreno necesario para constituirlo, así como de todo otro perjuicio (artículos 395 y 400 ibídem)."(hasta aquí la cita, lo subrayado no es del original). De dicha resolución se desprende, que la jurisprudencia patria acepta la constitución de una servidumbre de paso, por destino de padre de familia, cuando se cumplan ineludiblemente con dos requisitos, a saber, 1) que los inmuebles pertenecían a un mismo propietario; y, 2) El trazo de líneas continuas, como signos aparentes que denoten la existencia de la servidumbre.

A esa misma conclusión llega parte de nuestra doctrina al señalar: "La servidumbre por destino del padre de familia, no continúa, sino que "se constituye" al enajenar uno de los predios afectados por esa situación. Igual impropiedad tiene el artículo 531 del Código civil de España. Se ha establecido que la expresión "dos predios" se puede aplicar al caso de que el propietario de un solo predio haya constituido gravamen sobre una de sus porciones en provecho de otra, antes de su división..."(SOTELA MONTAÑE, Rogelio (comentarios), en: BRENES CORDOBA, Alberto, Tratado de los Bienes, Juricentro, 1981, p. 112). Otra autora subraya lo siguiente. "Si revisamos nuestra legislación, vemos que el artículo 380, reza que la servidumbre continuará al hacerse la división del fundo, o a trasmitirse uno de los fundos del propietario originario, a otro titular; en realidad lo que sucede es una transformación de un simple servicio entre partes o fundos de un mismo titular, porque opera el principio "nemini sua servit" ya visto.

Es importante tomar en cuenta que en esta situación, ya existía el servicio y éste continúa con la segregación del fundo, o con la transmisión de propiedad de un fundo a otro titular" (SANCHEZ BOZA, Roxana. Estudio de la Jurisprudencia judicial y administrativa respecto de las servidumbres. Universidad de Costa Rica, 1985, p. 98). Pese a lo anterior, existen aún quienes sostienen la aplicación restrictiva del instituto, solo para casos de servidumbres continuas y aparentes (BRENES CORDOBA, op. cit., p. 112, CHINCHILLA, José. Precisiones conceptuales sobre la regulación de la servidumbre por destino del padre de familia. En. Revista Jurídica Vox Iuris, UIA, Año 2, No. 1, 2005, p. 16-19). Sin embargo, dicha interpretación, no va acorde con la necesidad económica y social, de los bienes agrarios productivos, como se verá a continuación. X.- La jurisprudencia agraria de la Sala Primera de Casación, de la Corte Suprema de Justicia, ha establecido la vinculación que tienen las servidumbres agrarias con el destino productivo de los fundos, la empresa agraria, y el destino que le da a los fundos productivos el buen padre de familia.

Al respecto se indicó: "Un elemento fundamental, dentro de la estructura de la empresa agraria, es su organización. En ella participan bienes no solo materiales sino también inmateriales (instrumenta fundi). Los derechos adquiridos por el titular del fundo (iura fundi), como consecuencia del ejercicio de la agricultura y en vista a su necesidad o utilidad a los fines de la producción agraria, constituyen un valioso instrumento en su estructura organizativa. Normalmente los "iura fundi" se identifican con las servidumbres prediales del Derecho romano, más antiguamente calificadas como res mancipi. Son los llamados "derechos" del fundo y forman parte de la hacienda agraria vista como fundo-organización. La "exigencia de agua" de un fundo para las necesidades de cultivo o de acceso sobre la vía pública, para las comunicaciones a su exterior, crean derechos a favor del fundo enclavado. La utilidad de un fundo es utilizada por otro fundo. pero estos derechos no siempre coinciden con los derechos de servidumbre predial disciplinados por el Código Civil.

Las servidumbres típicas del Derecho romano (iter, via, actus,aquae ductus) eran, como se ha dicho, configuradas como res mancipi. Unidas a los exclavos, al ganado, a las instalaciones y a los aperos de labranza formaban los instrumentum fundi, es decir la organización haciendal. Esta construcción era posible por cuanto la servidumbre se concebía como un ius fundi, el cual se realizaba a través de un dominio material (mancipium) sobre las partes del fundo sirviente destinadas a la mejor utilización del fundo dominante. Esta antigua concepción de la servidumbre agraria estaba ligada a la concepción publicística de la propiedad rústica como dominio soberano y fue superada en el ámbito de la nueva concepción privatista de la propiedad romana. En el derecho moderno la servidumbre no puede ser concebida como pertenencia. Algunos de sus elementos característicos, como el de destinación, todavía permanecen y asumen aspectos relevantes.

En el acto de constitución de la servidumbre existe la intención, de parte del titular dominante, de destinarla a la organización de su fundo, logrando una utilidad económica del otro fundo. El destino de "buen padre de familia" es esencial para explicar la función económico-social en la constitución de la servidumbre. Esta función se liga a una elección completa del titular del fundo dominante quien ha querido obtener alguna utilidad de otro fundo para poderlo destinar al servicio propio." (No. 80 de las 14:30 horas del 19 de julio de 1995)..." (la negrita no corresponde a su original).-

IX. SOBRE LOS AGRAVIOS DE FONDO EN TORNO A LA ADQUISICIÓN DE LA SERVIDUMBRE POR PRESCRIPCIÓN POSITIVA Y POR ENCLAVE

Lleva razón el recurrente, mas los mismos son insuficientes para revocar la sentencia apelada, la cual se confirmará pero por otros motivos distintos a los que tuvo el Juzgado de primera instancia. Ciertamente, los agravios de fondo del recurso, que invocan que no procede la constitución de servidumbre por usucapión son de recibo, mientras que el de enclave del fundo es irrelevante tratándose de una acción negatoria. Esto por cuanto la sentencia apelada no desestima la demanda por dichos motivos, por lo que dichos agravios no tienen relación con lo resuelto. Se rechazan los agravios de fondo analizados.-

X. SOBRE LOS AGRAVIOS DE FONDO RELATIVOS A LA FALTA DE DEMOSTRACIÓN DE LA EXISTENCIA DE LA SERVIDUMBRE

No lleva razón el recurrente. El agravio relativo a que no se demostró el título de una servidumbre constituida conforme a los artículos 378 y 308 del Código Civil, es de recibo, pero insuficiente para revocar la sentencia impugnada. Este Tribunal concluye, valorando la prueba bajo el sistema de libre valoración de la prueba contenida en el numeral 56 de la Ley de Jurisdicción Agraria, que el convenio tácito entre los anteriores propietarios de las fincas (los hermanos Pedro, José Angel y Roberto, Prado Segura) es producto de una servidumbre de destino de padre de familia, al tenor del artículo 380 del Código Civil. Y por ende, la demanda de acción negatoria no puede prosperar al existir una falta de derecho. No lleva razón la apelante en cuanto a que no se demostró que sobre su finca pese una servidumbre de destino de padre de familia, lo cual se extrae de la misma prueba ofrecida por el recurrente en carácter de prueba para mejor resolver y los asientos registrales históricos de las fincas que dieron origen a las fincas de las partes.

Conviene analizar la prueba para determinar en forma cronológica como se constituyó la servidumbre de destino de padre de familia. Historia de la finca 548944-000 cuya propietaria es la actora: El día 11 de agosto de 1956, Claudio Fallas García vendió a Pedro Prado Segura la finca 139456 (testimonio de escritura admitida como prueba para mejor resolver a imagen 10 del recurso de apelación). Nueve años, después, el 24 de abril de 1965, Roberto, Pedro y José Angel Prado Segura dueños por partes iguales de la finca 154579 vendieron dicha finca a Azucena Prado Segura (asiento registral a imagen 84). Ese mismo día, Azucena Prado Segura vendió a Pedro Prado Segura la finca 154579 y se convierte en la finca 177426 (asiento registral a imagen 84). La finca matrícula 548944-000, es producto de la reunión de las fincas matrículas 139456 y 177426, las cuales pertenecían a Pedro Prado Segura, cuya reunión y venta que éste hiciera a PRADO DEL SUR Y ASOCIADOS SOCIEDAD ANÓNIMA, se produce mediante escritura pública No. 53 de las diez horas del diez de julio del dos mil cuatro, ante el Notario Juan Edgar Fallas García (escritura pública en imágenes 5 y 6 del expediente electrónico).

Ocho años después, PRADO DEL SUR Y ASOCIADOS SOCIEDAD ANÓNIMA, vende la finca número 548944-000 a la actora, mediante escritura pública No. 91 de las once horas del veinte de abril del dos mil doce, ante el Notario Juan Edgar Fallas García, de manera que cuando ésta adquiere conocía del uso del camino, dada la relación de parentesco que existió entre los titulares de los fundos sirviente y dominante y porque de toda la vida habitó en el inmueble de su padre Pedro Prado Segura, lo cual lo reconoció en la declaración de parte de la actora Ana Isabel Prado Chinchilla en audio incorporado el 15/02/2022 13:49:08 en la que reconoce la vieja data de la existencia del camino cuando la finca pertenecía a su padre. Historia de la finca 612150-000 cuyos copropietarios son los demandados: El 24 de abril de 1976, Roberto Prado Segura segregó y vendió de su finca 248899 un lote a su hermano José Angel Prado Segura creando la finca 248901 (asiento registral a imagen 75).

Ese mismo día, 24 de abril de 1976, Pedro, Roberto y José Angel Prado Segura como dueños por partes iguales de la finca 248893, la dividen en tres lotes , uno de ellos, el número 2 se lo adjudica José Angel Prado Segura. Creando la finca 248897 (asiento registral a imagen 78). También quedó demostrado que don José Ángel Prado Segura, como anterior propietario de las fincas matrículas 248901-000 y 248897-000, hoy finca 612150 derechos 001 y 002, había hecho uso del camino en conflicto por acuerdo verbal con sus hermanos Roberto y Pedro, que eran copropietarios como él de la finca 154579 que se convirtió en la finca 177426 y que formó por reunión lo que es ahora la finca 548944-000 de la actora. Don José Angel, utilizó el camino con el fin de usarlo como único acceso -a pie, a caballo, o en vehículo- a su fundo, donde tenía su casa, agricultura y ganadería, según se demuestra con la testimonial de Aurelio Mora Cruz en audio 15/02/2022 13:50:08, Marvin José Prado Monge audio incorporado el 15/02/2022 13:50:31 y Noé Eduardo Elizondo Arias en audio incorporado el 15/02/2022 13:49:44.

Luego, en el año 2003, la finca matrícula número 612150 derechos 001 y 002, nace como producto de la reunión de las fincas 248901-000 y 248897-000, siendo que su anterior dueño era José Ángel Prado Segura, quien las reunió y donó a sus hijos Ilver Antonio Prado Monge y Marvin Prado Monge, mediante escritura pública No. 41 de las ocho horas del once de setiembre del dos mil tres, otorgada ante el Notario Sergio Vidal Zúñiga López (escritura pública en imágenes 18 y 19 del expediente electrónico). El uso del camino en conflicto en la finca de la actora, presenta signos aparentes de su existencia, la cual está dibujada en el plano catastrado SJ 815296-2002, inicia en el vértice 14 rumbo oeste-.este en donde existe un portón metálico frente a calle pública, se llega luego a otro portón metálico situado en el área de repastos de la actora, y finalmente un portillo que implica el límite de finca de la actora con el fundo de un tercero colindante de nombre Adolfo Valverde, se sigue la ruta por fundo de ese tercero, hasta llegar a finca de los demandados, segun se demuestra con el plano catastrado en imagen 3 del expediente electrónico, audio de reconocimiento judicial incorporado 16/07/2021 16:11:57 y videos registrados en disco compacto.

El artículo 380 del Código Civil establece que "La existencia de un signo aparente de servidumbre continua entre dos predios, establecido por el propietario de ambos, basta para que la servidumbre continúe activa o pasivamente, a no ser que al tiempo de separarse la propiedad de los dos predios, se exprese lo contrario en el título de enajenación de cualquiera de ellos". La doctrina indica sobre dicha norma: "En el caso de las servidumbres se exige que el PROPIETARIO DE ambas hubiere dejado un signo aparente de servicio entre los predios" (ALBALADEJO, (Manuel). Derechos Reales: Iura in Rei Aliena comentado para Costa Rica por Ricardo Zeledón, Tomo III, San José, EIJSA, 2012, p. 189. Siendo que los hermanos Pedro, Roberto y José Angel, todos ellos Prado Segura, eran copropietarios por partes iguales de las fincas que originaron las fincas de las partes y que desde el año 1956 establecieron el paso a favor de los que es hoy la finca de los codemandados a través de lo que es en la actualidad la finca de la actora, con signos aparentes que no han desaparecido hasta el día de hoy ni se ha establecido lo contrario hasta la fecha, la existencia de una servidumbre de destino de padre de familia ha sido demostrada por lo que los agravios no son de recibo y debe confirmarse la sentencia impugnada por las razones anteriores.

XI. RAZONES ADICIONALES DEL JUEZ ULATE CHACÓN

El suscrito comparte el voto de mayoría, pero considera necesario realizar algunas consideraciones adicionales, en torno a la interpretación normativa del Código Civil, a la luz del texto de la Constitución Política, los principios del Derecho Agrario y la evolución de los derechos reales en el derecho comparado. En efecto, este Tribunal Agrario, se ha decantado, desde hace más de 15 años, por una interpretación sistemática, material y evolutiva, de las normas vinculadas a la importancia de la servidumbre agraria y, en particular, a la servidumbre de paso, estableciendo en casos concretos, la necesidad de partir del principio de la función económica, social y ambiental de la propiedad agraria, y de los derechos reales en cosa ajena, o derechos limitados, como son las servidumbres. 1.- La doctrina europea, en particular la Española (Busto Lagos, José Manuel. La usucapión de la titularidad de la servidumbre de paso.

Monografías Jurídicas dirigida por Manuel Albaladejo García y silvia Díaz Alabart; Madrid, España, Edersa, 2000) ha desarrollado con gran tino el cambio jurisprudencial en el derecho español. También en Costa Rica, se ha profundizado sobre la necesidad y utilidad de una reinterpretación normativa del Código Civil para aceptar no solamente la usucapión de las servidumbre de paso, sino también el convenio tácito. (García Murillo, José Daniel y Barboza Castro, Natalia. “El reconocimiento de la usucapión y el convenio tácito en la adquisición de las servidumbres de paso en Costa Rica” Tesis de grado para optar al título de Licenciatura en Derecho. Facultad de Derecho, Universidad de Costa Rica, 2024. Páginas 141 a 146.). En cuanto al primer aspecto, relacionado con la prescripción de la servidumbre, el recurrente plantea el tema en segunda instancia y es replicado, razón por la cual este Tribunal bien podría entrar a analizar dicha usucapión o prescripción positiva, al tenor de lo dispuesto en el artículo 851 del Código Civil: "La renuncia de la prescripción puede ser tácita; y resulta de o oponer la excepción antes de la sentencia firme o de quien pueda oponerla manifieste por un hecho suyo que reconoce el derecho del dueño o del acreedor".

Por ende el argumento de quien recurre no sería válido, como tampoco es aceptable que se aplique un criterio interpretativo decimonónico, derivado de la literalidad de los artículos 378 y 379 del Código Civil. Porque en este caso, resulta sumamente claro, que desde hace más de 50 años, existen signos visibles, aparentes, exteriorizado por aspectos externos (calzada, delimitación, uso continuo), que han reconocido tanto los dueños originales, como sus trasmitentes y últimos adquirentes. Una posesión pública, pacífica e ininterrumpida, pero además, sumergida en una consentimiento tácito que suma el justo título o causa adquisitiva del derecho real de servidumbre agraria. La misma doctrina antes citada, así como los Códigos Civiles modernos, ni siquiera contemplan la distinción de las servidumbres continuas y aparentes, respecto a las discontinuas y las continuas no aparentes. Porque fue superada por el legislador y por criterios interpretativos jurisprudenciales de acuerdo a la realidad agraria y urbana, atendiendo al ejercicio pleno de la función económica, social y ambiental de la propiedad agraria.

La servidumbre agraria, en función del ejercicio productivo inmobiliario, que se integra a los derechos fundiarios (iura fundi), de la hacienda agraria, y que sirve a las actividades agrarias empresariales productivas, en este caso, durante más de cincuenta años. Servidumbres existentes, admitidas por convenio tácito, y trasmitidas, junto con los inmuebles dominante y sirvientes, de generación en generación. El convenio tácito es consecuencia de un negocio jurídico, en este caso verbal consistente en un acuerdo de voluntades por parte del propietario del fundo sirviente a favor del fundo dominante. De una sana interpretación del artículo 308, que dispone: “tratándose de servidumbres continuas no aparentes, o de servidumbres discontinuas, el reclamo, para ser atendible, debe fundarse en título que provenga del propietario del fundo sirviente, o de aquellos de quienes éste lo hubo” Además, el artículo 379 dice: “las servidumbres discontinuas de toda clase y las continuas no aparentes, sólo pueden constituirse por convenio o por última voluntad.

La posesión, aun la inmemorial, no basta para establecerlas”. La posibilidad de constituir la servidumbre de paso mediante convenio tácito, como bien lo indica la doctrina, representa una alternativa distinta a la prescripción, siendo el único requisito demostrar la existencia de dicho convenio. El Código Civil, no define explícitamente qué constituye un “convenio” o “título”, dejando abierta la posibilidad de que sea escrito, verbal, o que se deduzca de hechos que respalden la voluntad del propietario del fundo sirviente, concurriendo con la del dominante, al tenor del artículo 1022 del Código Civil (el convenio es ley entre las partes). Y justamente una de esas manifestaciones del convenio tácito, como se verá, es el caso de la servidumbre por destino de padre de familia. Por lo tanto, es fundamental verificar la voluntad de las partes, especialmente la del propietario del fundo sirviente.

La voluntad de constituir la servidumbre de paso mediante convenio tácito se respalda en la amplia concepción que el Código Civil otorga al convenio, como se establece en el artículo 1008, el cual establece que: “El consentimiento de las partes debe ser libre y claramente manifestado. La manifestación puede ser hecha de palabra, por escrito o por hechos de que necesariamente se deduzca”. Por ende, aquí en ese caso concreto el convenio está acreditado por los hechos tenidos por demostrados y que evidencian, no solo la voluntad del propietario del fundo sirviente de otorgar la servidumbre, sino, también, la voluntad del propietario del fundo dominante de recibirla y aprovecharla para la utilidad y ejercicio de la función social de la propiedad. 2.- Este Tribunal agrario, en Resolución número 878 del 2013 del Tribunal Agrario desarrolló en un caso concreto lo siguiente: "Es indudable, que como parte de la función social y económica de la propiedad, se encuentra la limitación de otorgarse derechos de paso entre predios vecinos, que es parte de la paz social del país y requisito indispensable de la producción en nuestras zonas agrarias.

La actualización de la servidumbre desde el punto de vista constitucional, exige que revisemos ese criterio puramente doctrinario, de concebir la servidumbre de paso como discontinua y con ello negar la usucapión de la posesión de la servidumbre, pues aplicando las reglas de la lógica en el caso de las servidumbres agrarias, lo que sucede es que el uso del paso, se dará en función de las necesidades del cultivo, para extraer cosechas, llevar insumos, materiales o mano de obra al trabajo. Un uso reiterado de esas actividades, supondrían la existencia de un convenio tácito entre las partes, salvo que de la casuística del caso que demostrada la mera tolerancia, la cual se reviste de otras características, como son un acto unilateral y probablemente un tiempo menor de uso, sumado a la ausencia de otros factores, como confianza o familiaridad entre las partes. II El concepto de convenio en la legislación, la costumbre como fuente de derecho en las servidumbres agrarias de paso y los requisitos de la posesión.

Independientemente de lo expresado en el análisis anterior, la normativa nacional, si reconoce como medio de adquisición de una servidumbre discontinua y aparente, el convenio, tanto en el caso de servidumbres continuas y aparentes como discontinuas (artículos 378 y 379 del Código Civil. En cuanto a la acepción de convenio, éste es definido por el célebre jurista Guillermo Cabanellas como: “el concierto de voluntades, expresado en convención, pacto, contrato tratado o ajuste. Sinónimo de cualquiera de estos vocablos que implican acuerdo, por la elasticidad y uso generalizado que a convenio se le da; no obstante las diferenciaciones técnicas que en cada remisión se concretan..” (Guillermo Diccionario Enciclopédico de Derecho Usual, Tomo 2, Editorial Heliasta. pag. 365). Como bien lo dice don Guillermo Cabanellas el convenio es un instituto elástico, donde lo fundamental es que se exprese el consentimiento, lo que él llama concierto de voluntades.

En la realidad rural costarricense el convenio es una fuente importantísima de Derecho, normalmente expresado por costumbre en forma verbal. Es importante al respecto diferenciar el acto tolerado al convenio. La tolerancia es típicamente un acto unilateral que expresa una intención de quien otorga la tolerancia, de permitir una conducta o ciertos actos, sujetos a la condición de que en cualquier momento puede ser revocada, sin reclamo alguno de quien es beneficiario de la misma. En el convenio aunque sea verbal, hay una expresión clara de consentimiento de las partes. Será un aspecto de prueba la demostración de ese consentimiento. Evidentemente, si bien la normativa señala que la posesión, aún la inmemorial, no basta para constituir servidumbres que llama discontinuas y aparentes, como la de paso, es jurídicamente correcto afirmar que en la valoración probatoria de un convenio tácito, la existencia de una posesión pacífica, pública, ininterrumpida a título de dueño, de un paso, constituye un elemento probatorio de gran importancia.

No, aceptar lo anterior, sería hacer nugatorio, el instituto de la posesión, tan prolijamente regulado en nuestro ordenamiento jurídico. Los requisitos que se le impone al derecho de posesión, para ser reconocido como tal, son los contemplados en el artículo 856 del Código Civil, a saber: la calidad de propietario en forma continua, pública y pacífica. En el caso de un paso, esos requisitos, harían necesario que quien use el paso se considere dueño del derecho al mismo, el que sea un uso continuo, sin que ello signifique un ejercicio permanente del paso, pues ello sería contrario a la lógica, - como ya dijimos antes - ; lo que en realidad sería exigido sería un uso constante, a contrario sensu , de lo que la misma ley establece, como pérdida por no uso y luego que sea pública y pacífica. (...) Hay que recordar finalmente que nuestro derecho adhiere el sistema de transmisión de bienes por nudo consenso, no existiendo la obligación de que la servidumbre se encuentre inscrita para que opere de pleno derecho entre las partes que la han convenido por convenio tácito (artículo 480 del Código Civil) (Tribunal Agrario, Voto No. 878 del 16 de setiembre del 2013)- 3.- La servidumbre por destino de padre de familia, es una manifestación evidente de un convenio tácito (como ocurre en este caso).

El artículo 380 del Código Civil establece: “La existencia de un signo aparente de servidumbre continua entre dos predios, establecido por el propietario de ambos, basta para que la servidumbre continúe activa o pasivamente, a no ser que, al tiempo de separarse la propiedad de los dos predios, se exprese lo contrario en el título de la enajenación de cualquiera de ellos”. En primer lugar, es relevante mencionar que la norma no establece la necesidad de un título escrito para constituir esta servidumbre, lo que permite la existencia de títulos mudos o tácitos en nuestro ordenamiento, basados en los rasgos o la apariencia de su existencia entre los dos predios, como es el caso. De acuerdo con el razonamiento de la Sala Primera en la sentencia No. 380-F-00 de las 16:45 horas del 19 de mayo de 2000, se aclara la interpretación de la norma: De conformidad con el tenor literal de ese artículo, uno de los requisitos indispensables para la procedencia de esta modalidad de constitución de servidumbre, es que los dos fundos pertenezcan a un solo propietario.

De conformidad con la sustanciación y las certificaciones aportadas con el recurso, se coincide con el casacionista cuando echa de menos tal requisito en el sub-júdice.Por otro lado, considera esta Sala, es cuestionable la existencia de signos aparentes de servidumbre al momento de hacerse la parcelación de tierras. Sea dicho trazo de líneas continuas que denotan la existencia de la servidumbre, no pasa por ese inmueble. Por último, conforme lo ha resuelto reiteradamente esta Sala, la indemnización del valor del terreno y cualquier otro perjuicio, es un elemento inherente a la servidumbre forzosa. Nuestro ordenamiento jurídico, al igual que otros, como el argentino, italiano y español, presenta una excepción a esa regla. Esta es, cuando el enclavamiento del fundo es producto de un negocio jurídico. En tales casos, se deberá constituir la servidumbre a favor del predio que en virtud del negocio haya quedado enclavado, sin indemnización alguna.

Así lo dispone el artículo 400 del Código Civil. En la especie, según lo apuntado anteriormente, éste no es el caso, pues los fundos no pertenecieron nunca al mismo propietario. Corolario de lo expuesto, en el sub-júdice no se está ante una servidumbre por destino de padre de familia, sino de una forzosa de paso, por tratarse de un fundo enclavado. Bastan las razones de hecho y de derecho expuestas para arribar a la conclusión dicha. Por ende, resulta innecesario reparar en otras alegaciones esgrimidas con esa finalidad. Además, al no configurarse el supuesto de excepción regulado en el Código Civil, procede reconocer, a favor de todos los propietarios demandados, cuyas fincas se verán afectadas por ese gravamen, el pago de la indemnización del valor del terreno necesario para constituirse, así como de todo otro perjuicio (artículos 395 y 400 ibídem) Sala Primera de Casación, sentencia No. 380-F-00 de las 16:45 minutos del 19 de mayo del 2000.- Del extracto citado se desprende que la jurisprudencia costarricense acepta la constitución de una servidumbre de paso por destino de padre de familia, para lo cual deben cumplirse dos elementos indispensables: 1) que los inmuebles pertenecieran a un mismo propietario; y 2) que se compruebe la existencia de líneas continuas o signos aparentes que indiquen la existencia de la servidumbre.

La misma jurisprudencia de la Sala Primera ha reconocido la constitución de servidumbres por destino de padre de familia, las cuales pueden surgir de un título mudo, es decir, de la existencia de signos o líneas aparentes que denoten dicha servidumbre. Por lo tanto, se descarta la necesidad de un título escrito emitido por el propietario de los fundos afectados por esta servidumbre, lo que abre la posibilidad de constituir una servidumbre mediante un convenio tácito.(García Murillo, José Daniel y Barboza Castro, Natalia. “El reconocimiento de la usucapión y el convenio tácito en la adquisición de las servidumbres de paso en Costa Rica” Tesis de grado para optar al título de Licenciatura en Derecho. Facultad de Derecho, Universidad de Costa Rica, 2024. Páginas 141 a 146.). 4.- Este Tribunal, incluso en sede sumaria, ha reflexionado sobre la importancia de tutelar la servidumbre de paso, tratándose de fundos enclavados, dejando la discusión de la existencia de un consentimiento y convenio tácito para la vía declarativa, así en Voto No. 494 del 22 de mayo del 2024 se indicó lo siguiente: "VIII.- ..Lógicamente, la tutela opera cuando el empresario agrario se ve amenazado en el ejercicio de su actividad económica por hechos o actos que perturben esa posesión agraria, o que despojen parcial o totalmente al mismo del fundo, o de los llamados "iura fundi", o derechos sobre los cuales se ejerce la posesión actual y momentánea y que son de utilidad para el ejercicio continuo, estable y efectivo de la actividad productiva.

Eso puede ocurrir, a guisa de ejemplo, cuando se cierra el paso o camino para extraer la producción agraria, sea los frutos, sea los animales, lo cual puede provocar, eventuales perjuicios al empresario agrario por la imposibilidad de seguir cosechando u obteniendo el producto a raíz del cierre del paso o camino.- En tercer lugar, es importante recordar que, de acuerdo a la jurisprudencia agraria consolidada, se ha considerado que la servidumbre agraria, derecho de paso, es un derecho real que desde la época romana fue de gran utilidad para que los fundos pudieran cumplir su función económica, social y ahora ambiental. Ciertamente, se ha considerado un "iura fundi" al servicio de los inmuebles o fundos agrarios que requieren tener un acceso a calle pública, pero además que ese acceso se útil para el ejercicio de la actividad económica. Ahora bien, estos "iura fundi" o derechos sobre el fundo, pueden llegar a constituirse o crearse en los modos que el propio ordenamiento jurídico establece.

De acuerdo a la naturaleza o tipo de servidumbre, se han realizado algunas calificaciones legales por parte de legislador decimonónico (el Código Civil es de 1988), y algunas categorizaciones no corresponden a la realidad agraria. De ahí que es importante clarificar algunos conceptos, a fin de poder resolver este caso a la luz de la doctrina y la jurisprudencia más moderna, sin perder de vista que estamos en presencia de un interdicto de amparo de posesión, y que los derechos de propiedad y derechos reales definitivos, no se juzgan en esta vía que es para proteger, como se ha dicho, la actividad agraria productiva. En ese orden de ideas, es importante considerar que la servidumbre de paso, si bien es cierto se ha considerado como una servidumbre "discontinua y no aparente", la realidad agraria de los fundos muchas veces demuestran cosa distinta, por la existencia de signos visibles por el transcurso del tiempo, y por la continuidad de la actividad agraria.

De manera tal que la existencia de signos visibles, la continuidad de una servidumbre, y la existencia de manifestaciones de las partes, podrían conllevar a categorizar la existencia de un eventual convenio entre partes, para la existencia de una servidumbre de paso agraria, pero ello es una discusión propia de la vía declarativa. Por otra parte, también en juicio de verosimilitud, es importante recordar que cuando se habla de "enclave" de un fundo, el ordenamiento jurídico contiene un par de supuestos, cuales son, que el fundo esté enclavado porque del todo no tiene salida, o no tiene salida bastante a la vía pública, para el ejercicio adecuado a la actividad agraria productiva que desarrolla (artículo 395 del Código Civil). En cuarto lugar, es importante considerar que cuando existen actividades agrarias productivas, de producción contínua, en el caso particular de la actividad lechera, es evidente que el ciclo productivo y de aprovechamiento (ordeño), es contínuo debiendo considerarse el estado físico de los animales.

Esa actividad continua, significa que no se trata de un acto de disfrute parcial o esporádico, como podría ser la existencia de una servidumbre de abrevadero, sino que debe tratarse de un disfrute continuo y total para el aprovechamiento de la actividad productiva dos veces al día. Ese punto de vista, hace la diferencia entre el ejercicio de una posesión agraria contínua, estable, productiva, y un acto de mera tolerancia como acto de disfrute parcial del bien por consentimiento del vecino o del dueño del inmueble sobre el cual se ejerce esa mera tolerancia (Brenes Córdoba). Evidentemente los actos facultativos o de mera tolerancia, entendidos como un difrute parcial, no dan derecho de posesión (artículo 279 del Código Civil). La mera tolerancia, en consecuencia, es un acto unilateral del propietario o poseedor, de disfrute parcial, lo que es distinto a que ambas partes aporten para la construcción de un acceso entre un fundo y otro, como aparentemente, según veremos, ocurre en este caso.". 5.- En este caso particular, nos encontramos frente a una demanda ordinaria de acción negatoria, a la cual se le opuso la parte demandada, señalando que la servidumbre existe desde hace más de cincuenta años.- Como se indica en las consideraciones de fondo de mayoría, efectivamente la servidumbre se constituyó por convenio entre hermanos, que tenían una cotitularidad de los dos fundos (sirviente y dominante), lo que decantaría en la existencia de una servidumbre por destino de padre de familia, que no se desdijo en las diversas transmisiones, entre los adquirentes sucesivos (familiares).

Pero el énfasis es el convenio.- Ahora bien, si partimos de la hipótesis de la acción negatoria, hay que recordar, nuevamente la doctrina española: "La doctrina y jurisprudencia acepta que, pese a no contemplarse esta posibilidad con carácter general en el C.C., el dueño de un predio dispone de la llamada "acción negatoria" para defender la integridad de su derecho dominical frente a cualquier pretendida limitación del mismo proveniente del ejercicio de la posesión, en este caso, de un derecho real limitado de servidumbre de paso, solicitando que el órgano judicial competente dicte una sentencia que declare la inexistencia del pretendido gravamen y la reintegración de la plenitud del dominio. Parece claro que si la posibilidad de ejercicio de esta acción prescribiera por el transcurso de un determinado lapso de tiempo, el propietario del pretendido fundo sirviente no podría ejercitarla frente al poder ad usucapionem de la misma y ello con independencia de que se hubiese consumado o no los efectos adquisitivos de esta posesión..." (Busto Lago, op.cit., p. 289).

De lo anterior se desprende que la acción negatoria no procedería si la servidumbre está legalmente constituida por la demostración de un convenio tácito, como ocurre en este caso, reforzada por el hecho de que, existiendo un destino y uso continuado por más de diez años, la misma no se desdice en los títulos traslativos de dominio, ni en la información del registro inmobiliario, que contempla la descripción física de la servidumbre en los planos catastrados.-

POR TANTO

Se confirma la sentencia en lo que fue objeto de apelación, por las razones aquí explicadas. El juez ULATE CHACÓN da razones adicionales para confirmar el fallo.- ????????????????
