MUNICIPALIDAD DE OROTINA N° 2024003114 ADMINISTRATIVE AND CIVIL TAX COURT, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at fifteen hours and fourteen minutes on trece de Mayo del dos mil veinticuatro.- Merits Proceeding filed by Ms. [Nombre 002], [...], against the MUNICIPALIDAD DE OROTINA, represented by Mr. Randall Marín Orozco, holder of identity card N° 2-0452-0092 and Costa Rican Bar Association membership card Nº 5586, in his capacity as special litigation counsel (apoderado judicial especial). Mr. Joan Castillo Umaña, holder of Costa Rican Bar Association membership card Nº 8583, participates as litigation counsel for the plaintiff in these proceedings.
PROCEDURAL ACTIONS. The following form part of the procedural history (íter procesal):
By a complaint filed on 17 de junio del 2021, the plaintiff asserted the following claims, seeking a judgment declaring as follows: “-That it be declared by judgment that the property I own, recorded in the National Registry, Real Property Section, Province of Alajuela, under Real Property Folio number 322557-000, is encumbered by a water-conveyance easement (servidumbre de conducción de aguas) belonging to the Municipalidad de Orotina, without the latter having paid any amount as compensation for expropriation. - That it be declared that the Municipalidad de Orotina failed to comply with the required administrative expropriation and compensation procedure for the benefit of the owner of the property in the Alajuela Registry District, Real Property Folio number 322557-000, in connection with the installation of a water easement on said property. - I request that the defendant be ordered to pay for the area of land comprising the easement, to pay for the damage to the remainder of the property, to pay the indexation (indexación) to which I am entitled, and to pay statutory interest, which must be calculated from the date possession of the land was taken, that is, from 15 de enero del año 2004 until the date on which the established amount is actually paid; such interest shall be calculated on the amount of compensation and in accordance with the interest rate for 6-month certificates of deposit issued by Banco Nacional de Costa Rica. - I request that the Municipalidad de Orotina be ordered to repair the water easement installed on my property and extend its channelization so that the water flowing through it is carried out of my property through its northern boundary, thereby ensuring that the water is properly and effectively conveyed to a safe location. - I request that the defendant be ordered to pay the attorney’s fees and procedural costs of this action.” Those claims remained unchanged at the Preliminary Hearing held on 06 de julio de 2012.

By the ruling issued at 9:40 hours on 24 de agosto de 2021, the Administrative and Civil Tax Court ordered the plaintiff to amend the factual allegations in her complaint in accordance with sections 58 and 61 of the Code of Administrative Procedure (Código Procesal Contencioso Administrativo; hereinafter, CPCA). (See images 26 and 27 of the electronic court file).
By a brief dated 03 de setiembre de 2021, the plaintiff’s legal representative complied with the order issued in the ruling of 9:40 hours on 24 de agosto de 2021 by the Administrative and Civil Tax Court, specifically amending the factual allegations in the complaint while leaving unchanged the claims asserted and the evidence offered therein. (See images 29 through 31 of the electronic court file).
After the Administrative and Civil Tax Court served the complaint on the Municipalidad de Orotina by a ruling issued at 10:00 hours on 12 de octubre de 2021, the Municipalidad filed its answer on 02 de diciembre de 2021, denying the complaint and asserting the defenses of lack of standing to be sued (falta de legitimación pasiva) and failure to state a legal right (falta de derecho). It therefore requested that the complaint be dismissed in its entirety and that the plaintiff be ordered to pay both categories of costs. (See images 33 through 35 and 40 through 54 of the electronic court file).
By a ruling issued at 11:03 hours on 04 de marzo de 2022, the Administrative and Civil Tax Court granted the plaintiff a period of three (3) business days to respond to the defenses of lack of standing to sue (falta de legitimación activa) and failure to state a legal right asserted by the Municipal Corporation in its answer to the complaint. As of the date of this judgment, there is no record that Ms. [Nombre 002] submitted any response to that hearing. (See images 215 and 216 of the electronic court file).
The preliminary hearing was held on 06 de julio del 2022, with the plaintiff and representatives of the defendant Municipalidad in attendance. At the hearing, the parties stated that they had found no defects in the proceedings; the claims were maintained as set forth in the complaint; all facts except the third were identified as disputed facts; and the documentary evidence submitted by both parties was admitted. As for the testimonial evidence offered by the plaintiff, Mr. Luis Fernando Araya Arguedas, holder of identity card N° 1-0736-0171, was admitted as a witness. As for the testimonial evidence offered by the Municipalidad de Orotina, Messrs. Juan Paulo González Calderón, holder of identity card N° 1-1348-0230; Javier Umaña Durán, holder of identity card N° 1-954-0885; and José Pablo Rojas González, holder of identity card N° 1-1274-0333, were admitted as witnesses. In addition, the appointment of a Surveying Engineer as a court-appointed expert (perito judicial) was authorized. It was ordered that these proceedings be transferred to the Trial Section assigned by rotation. (See the Audio Recording and Minutes of the Preliminary Hearing, appearing at images 231 through 235 of the electronic court file).
On 10 de octubre de 2022, Mr. Luis Jonathan González Portuguez, a Surveying Engineer registered under N° IT-21339 and holder of identity card N° 1-0959-0759, submitted the corresponding expert report (informe pericial). (See images 265 through 267 of the electronic court file).
On 13 de octubre de 2022, the plaintiff’s representative requested the appointment of an appraisal expert, which request was denied by the ruling issued at 15:04 hours on 31 de octubre de 2022 by the Administrative and Civil Tax Court. (See images 277 and 278 of the electronic court file).
By the ruling issued at 15:04 hours on 31 de octubre de 2022, the Administrative and Civil Tax Court granted the parties a period of three (3) business days to address the expert report submitted on 10 de octubre de 2022. On 02 y 07 de noviembre de 2022, the plaintiff and the defendant, respectively, requested supplementation and clarification of that Expert Report. (See images 278 through 285 of the electronic court file).
By a ruling issued at 13:28 hours on 15 de noviembre de 2022, the Administrative and Civil Tax Court granted Mr. González Portuguez a period of three (3) business days to address the requests for supplementation and clarification of the Expert Report submitted. (See image 288 of the electronic court file).
On 06 de diciembre de 2022, Mr. González Portuguez responded to the requests for supplementation and clarification of the Expert Report submitted by both parties. (See images 335 through 347 of the electronic court file).
By the ruling issued at 13:32 hours on 09 de enero de 2023, the Administrative and Civil Tax Court granted the parties a hearing so that they could respond to the matters stated by Mr. González Portuguez concerning the expert evidence submitted. (See image 348 of the electronic court file).
On that date, the Municipalidad de Orotina reiterated its request for supplementation of the Expert Report prepared by Mr. González Portuguez. (See images 349 and 350 of the electronic court file).
By a ruling issued at 10:10 hours on 27 de febrero de 2028, the Case Management Judge scheduled the oral and public trial, and the court file in question was assigned on 18 de enero de 2023 to this First Section of the Administrative and Civil Tax Court for adjudication. (See images 354 through 359 of the electronic court file).
The oral and public trial was held at 8:30 hours on 29 de abril de 2024, with both parties to the proceedings in attendance. At the hearing, the parties stated that there were no procedural matters requiring correction, and the plaintiff requested the admission, as evidence to facilitate adjudication (prueba para mejor resolver), of a judicial ruling issued by the Administrative and Civil Tax Court. This panel did not admit it because it did not constitute evidence in the technical sense, although the ruling was noted for the appropriate purposes. The parties delivered their opening statements, and the admitted expert testimony of Mr. Luis Jonathan González Portuguez was received. Testimony was also received from Messrs. Luis Fernando Araya Arguedas, identity card 1-0736-0171; Juan Paulo González Calderón, holder of identity card N° 1-1348-0230; Javier Umaña Durán, holder of identity card N° 1-954-0885; and José Pablo Rojas González, holder of identity card N° 1-1274-0333.
Both the plaintiff and the representatives of the Municipalidad were then given an opportunity to present closing arguments. In consideration of the body of evidence and the claims asserted in the complaint, pursuant to section 111, subsection 1), of the Code of Administrative Procedure and section 47 of the Autonomous Regulations on the Organization and Service of the Administrative and Civil Tax Jurisdiction, the proceeding was declared to be of Very Complex Processing, and issuance of the judgment was deferred for a period of fifteen (15) business days. (See the Minutes of the Oral and Public Trial and the Audio and Video recordings in SIGAO).
The statutory requirements and deadlines have been observed in these proceedings, and no flaws, defects, or omissions are apparent that could result in the nullity of the proceedings or a denial of due process to the parties. This ruling is issued unanimously, following deliberation by the members of this Court, in compliance with the criteria for prioritizing the handling of proceedings under the redesign of the Administrative and Civil Tax Court, and within the period established by section 111.1 of the Code of Administrative Procedure.

CONSIDERING
PROVEN FACTS: Based on the documentary evidence admitted in these proceedings and the expert and testimonial evidence presented during the Oral and Public Trial, the following facts are deemed proven and relevant to the issuance of this judgment, as they are supported by the corresponding evidence:
This was based, among other grounds, on the following: “(…) 18. That the Instituto de Desarrollo Agrario has developed housing projects or subdivisions (fraccionamientos) in Orotina without coordinating in any manner with the Municipality, including Cebadilla, Santa Rica, Cerro Bajo, Cerro Alto, Mollejones, Vivero, Huacas, Cámara, Los Mangos, and Cuatro Esquinas. 19. That the foregoing projects were designated as family farms, although they constitute agriculturally irrational divisions that conceal urban developments in order to avoid compliance with statutory provisions, because the subdivisions consist of areas between 1000 and 2000 square meters, creating smallholdings (minifundios) inconsistent with the IDA’s substantive function. (…) 21. That the Instituto Nacional de Vivienda y Urbanismo has no preliminary rural housing project or record of coordination submitted by the IDA for approval in the canton of Orotina, even though the Ley de Tierras requires it to coordinate its work with that entity.
Its development must be properly planned to provide basic infrastructure in coordination with other State entities and thereby achieve a harmonious and dignified environment for families; yet, as of today, 10 years after those farms were delivered, there are subdivisions without the services required by law for a dignified life. (…) That during the last two administrations and the elapsed portion of the current administration, the IDA Regional Director has never appeared before this Council to undertake any coordination regarding noncompliance, such as the lack of basic services, much less to propose an action plan to remedy the situation involving the IDA’s so-called family farm programs…” (Transcript of Resolution VI, Subsection 1, Part 2, from ordinary session N° 60 held on 02 de enero de 2007, appearing at images 187 through 193 of the electronic judicial case file).
(…) during the inspection conducted, it was observed that the water outfall (desfogue de aguas) passing through this property cannot be modified because it is located at the lowest point of the street and is the drainage point created by the developer of the residential development; therefore, diverting the current course of the stormwater, which in this case flows by gravity along the public road, would entail enormous costs for storm sewers, earthworks (movimientos de tierra), expropriations, and the loss of the investment made to date in improvements, (…)”. (See Official Letter N° MO-DPDT-IV-177-2021 dated 24 de noviembre de 2021, appearing at images 183 and 184 of the electronic judicial case file, and testimony of Messrs. Juan Pablo González Calderón and Javier Alberto Umaña Durán during the Oral and Public Trial Hearing).
That report considered matters such as the lack of Public Areas, Community Facilities, Parks, and Road Infrastructure, and the Centro Poblacional de El Vivero in Coyolar de Orotina, where property registration N° 2-322557-000 is located, originally in the name of Instituto de Desarrollo Rural (INDER), has not formally transferred these Community and/or Urban-Development Facilities to the Municipalidad de Orotina (…). Additionally, a survey of the contour lines in the area, along the right-of-way (derecho de vía), was (sic) conducted to verify the elevations; according to the analysis based on the interpretation of those lines, topographically, the point with the lowest elevations is located in front of the property in question. (…)”. (See Official Letter N° MO-A-DPDT-GT-100-2021 dated 30 de noviembre de 2021, appearing at images 178 and 179 of the electronic judicial case file).
The following are deemed facts not proven that are relevant to the issuance of the judgment, either because the parties failed to satisfy their burdens of proof or because this Court found no suitable evidence that, under the principle of sound judicial evaluation (sana crítica), would establish them:
In her complaint and during the closing-arguments phase conducted at the Oral and Public Trial hearing, the claimant, [Nombre 002], states that she owns the property located in Coyolar de Orotina, Provincia de Alajuela, recorded under real-property folio registration N° 322557-000, Lot 27 of the “El Vivero” Settlement. She objects that, without her consent (because she was not living on the property), on 15 de enero de 2004 the Municipalidad de Orotina constructed and installed a stormwater and wastewater easement (servidumbre de aguas pluviales y servidas) on her property, which crosses it from front to back, running south to north, with a length of approximately fifty linear meters and a width of two meters. That easement continues onto the adjoining property to the north and has remained in operation for 17 years, with continuing effects on her property interests. She alleges that the defendant Municipal Corporation did not conduct the expropriation proceedings (proceso expropiatorio) before establishing the stormwater easement on her property, thereby violating section 45 of the Constitución Política, Article 13 of the Ley de Expropiaciones, and Articles 190 and 191 of the Ley General de la Administración Pública.
She further alleges a violation of the ruling of the Sala Constitucional de la Corte Suprema de Justicia in Resolution N° 91-00796, issued at 15:10 hours on 26 de abril de 1991, insofar as it imposes a duty to provide compensation (deber indemnizatorio) both for the strip designated for the public good and for the remainder (remanente). Accordingly, she has not been compensated for the value of the land on which the stormwater easement is located or for the damage to the remainder (daños del remanente). She asserts that the easement on her property has not been recorded in the Registro Nacional and therefore lacks the corresponding public registry notice (publicidad registral). She continues by stating in the factual allegations of the subsequently amended complaint that “(...) this de facto easement (servidumbre de hecho) has affected the value of the property, because the damage caused to the remainder is very significant, since the direction of the easement affects the property from one end to the other, affecting it in its entirety; moreover, they did not complete the easement route within the neighboring property, they abandoned it, and three years ago the culvert they installed broke within my property.
This caused my property to be directly exposed to the impact of rainwater and wastewater because all the water coming from the street drain is channeled underground through my property, causing those liquids to be discharged onto the property and damaging it.” She contends that water stagnates on her property, creating mosquito breeding grounds that endanger the health of the persons living on that property (herself and her grandchildren, who are minors). In response to this situation, on 15 de enero de 2021, she filed a formal complaint with the Municipalidad de Orotina, which responded only through official letter N° MO-A-DPDT-003-2021 dated 03 de febrero de 2021, informing her that officials would visit her property; nevertheless, they have not resolved the reported problem. She therefore bases her complaint on the existence of civil liability (responsabilidad civil), from which arises “the obligation to remedy any pecuniary or non-pecuniary damage or loss that, in the performance of its duties, is caused” by the defendant Municipal Corporation.
She then transcribes sections 190 and 191 of the Ley General de la Administración Pública and Resolution N° 213-2008 of the Sala Primera de la Corte Suprema de Justicia concerning the predominantly strict-liability regime (régimen preeminentemente objetivo) governing liability for the lawful or unlawful, normal or abnormal operation of the Administration. Following this presentation of the legal framework, she states that “(...) in the present case, it is evident that the defendant, in its capacity as a public institution, decided to construct the easement at issue in order to provide an outlet for a water-disposal problem; as a result, it is required to obtain sufficient land for its construction and use, because it does not maintain it, which entails imposing a series of restrictions on construction, the accumulation of materials, the planting of trees, or the obstruction of the strip of land encompassed by it; this situation constitutes a substantial limitation on the essential attributes of my property because it prevents me from freely using and disposing of my parcel.” In light of the foregoing, she asserts the following claims for relief (pretensiones): “-That the judgment declare that the property I own, recorded in the Registro Nacional, Sección Inmueble, Provincia de Alajuela, Folio Real number 322557-000, is encumbered by a water-conveyance easement (servidumbre de conducción de aguas) in favor of the Municipalidad de Orotina, without the latter having paid any amount as expropriation compensation. - That it be declared that the Municipalidad de Orotina failed to comply with the required administrative expropriation and compensation proceedings (debido proceso administrativo de expropiación e indemnización) in favor of the owner of the property in the Partido de Alajuela, Folio Real number 322557-000, for the installation of a water easement on that property. - I request that the defendant be ordered to pay for the area of land comprising the easement, to compensate for the damage to the remainder of the property, to pay the monetary adjustment (indexación) to which I am entitled, and to pay statutory interest (intereses de ley), which must be calculated from the date possession of the land was taken, that is, from 15 de enero del año 2004 until the date on which the established amount is actually paid; such interest shall be calculated on the amount of compensation and in accordance with the interest rate on 6-month certificates of deposit issued by Banco Nacional de Costa Rica. - I request that the Municipalidad de Orotina be ordered to repair the water easement installed on my property and to extend its channeling so that the water flowing through it is carried out of my parcel through the northern boundary of my property and is properly and effectively conveyed to a safe location. - I request that the defendant be ordered to pay the attorney’s fees and litigation costs (costas personales y procesales) of this action.” Lastly, she bases her complaint on Articles 41 and 45 of the Constitución Política, sections 1045 and 1048 of the Código Civil, Articles 190 et seq. and related provisions of the Ley General de la Administración Pública, Ley de Expropiaciones, Código Procesal Civil, Ley N° 6313 del Código Procesal Contencioso Administrativo, and the case law of the Sala Primera de la Corte Suprema de Justicia, Voto N° 966-F-2005 issued at 14:10 hours on 15 de diciembre de 2005.-
In its response and closing arguments during the oral and public trial hearing, it states that the complaint filed by Ms. Venega Montoya must be dismissed in its entirety for the following reasons. First, it notes that it has been established that the plaintiff acquired title to the property in March 1997 directly from the Instituto de Desarrollo Agrario (currently the Instituto de Desarrollo Rural), and that the property is part of the subdivision project (proyecto de fraccionamiento) developed by that public institution, known as “Asentamiento El Vivero,” which originally consisted of 93 lots and currently consists of 122 lots. It further notes that, in November 1997, the plaintiff was a beneficiary of the housing subsidy for construction of her residence. In its view, since it has been established that IDA was the developer of Asentamiento El Vivero, IDA was responsible for providing the urban infrastructure required by the new owners, referring to basic services such as “the establishment of adequate access routes (public streets), the proper disposal of stormwater (outfall), and the provision of public-use areas (parks and community facilities), pursuant to the Ley de Planificación Urbana and the Reglamento para el Control Nacional de Fraccionamiento y Urbanizaciones then in force.” It states that, notwithstanding that legal obligation, El Vivero was not approved at any stage by the Municipalidad de Orotina: “it did not issue any authorization or approval for the project, construction plans, creation of streets, acceptance of works, or other activities customarily undertaken by developers.” It denies that the defendant Municipal Corporation constructed or installed the stormwater and wastewater easement (servidumbre de aguas pluviales y servidas) within the plaintiff’s property; rather, IDA developed that settlement in fulfillment of the duties established in the Ley de Creación del Instituto de Desarrollo Agrario, Ley N° 6735 del 29 de marzo de 1982, and the Ley de Tierras y Colonización, Ley N° 2825 del 14 de octubre de 1991, and therefore that public entity is responsible for providing basic services in subdivision projects.
The Municipality has no legal authorization whatsoever to enter upon a property and build on private property or invest public funds therein. It maintains that, beginning in 2014, pursuant to official letter MO-DPDT-IV-177-2021 del 24 de noviembre de 2021, the Local Government made certain investments exclusively in the public streets of Asentamiento “El Vivero,” but did so on the basis of preexisting conditions, including the stormwater outfall located on the property of Ms. [Nombre 002]. It considers that intervention distinct from the original development of Asentamiento El Vivero and from the construction of the outfall on the plaintiff’s property; the fact that it participated directly or indirectly in supplementary investments does not confer upon it the authority to perform works within a third party’s property. It reiterates that those works were not performed by the entity it represents and that neither Asentamiento El Vivero as a whole nor other settlements developed by IDA at that time were coordinated with the Municipality or underwent the municipal permit approval procedures.
It further states that “the available sources of information and the topographic survey conducted by the Municipalidad de Orotina show that the orographic and topographic conditions associated with the physical location of the plaintiff’s property reveal the existence of a natural slope that channels stormwater drainage through that property”; therefore, pursuant to Article 94 of the Ley de Aguas and section 20 of the Ley General de Caminos Públicos, the plaintiff must bear that restriction, without any need to expropriate her property. Furthermore, “if blockages, improper channeling, or flooding are occurring, the problem should be analyzed so that the parties involved—particularly the affected owners—with the support of the Municipalidad de Orotina and other competent institutions, may diagnose the causes and identify solutions, all within the applicable legal framework, particularly with respect to the use of public resources and the exercise of public powers.” Likewise, pursuant to section 20 of the Ley General de Caminos Públicos, the plaintiff, in her capacity as owner, is responsible for keeping the drains clean, in perfect working order, and free of obstructions.
It contends that the legal basis on which the plaintiff grounds her claims is incorrect because “the water crosses her land as a result of the natural slope created by the site’s orographic and topographic conditions, which, because they are natural, are not subject to expropriation or compensation, insofar as they constitute statutory or natural easements (servidumbres legales o naturales).” On the basis of the foregoing, counsel for the Municipalidad de Orotina raises the defenses of lack of standing to be sued (falta de legitimación pasiva) and lack of a legal right (falta de derecho). In addition, it requests that the complaint filed by Ms. [Nombre 002] be dismissed in its entirety and that she be ordered to pay both categories of litigation costs. –
An analysis of the case record, the complaint and its claims, as well as the closing arguments presented during the oral and public trial hearing, shows that the subject matter of the proceeding centers, on the one hand, on the request for a declaration that the Municipalidad de Orotina engaged in abnormal administrative inaction (funcionamiento anormal omisivo) by failing to carry out the administrative expropriation proceeding and, consequently, by also failing to fulfill its obligation to compensate the plaintiff for the land on which the water easement is currently installed. Her argument derives from this a financial liability of the Public Administration (responsabilidad patrimonial de la Administración), as grounds for payment for the requested expropriation of the land and for the damage to the remainder. However, it is also noted that she asserts no claim for any additional pecuniary or non-pecuniary damage (daño patrimonial o moral).
Accordingly, she seeks an order from this Court requiring the Municipal Corporation to pay for the area of land on which the water easement is located and for the damage caused to the remainder of the property; those amounts are to be adjusted for inflation, and statutory interest is to be awarded on them from the date possession of the land was taken (15 de enero de 2004) until the awarded sum is paid in full. In addition, she also seeks an order compelling the Local Government to act (pretensión de hacer), specifically by repairing the easement located on her property and ensuring the proper and effective conveyance of the water to the northern boundary. Therefore, this Court’s analysis is based on the factual and legal framework arising from the contents of the complaint, the response thereto, and the closing arguments of both parties during the Oral and Public Trial, as well as a comprehensive assessment of the admitted evidence, excluding the matters referenced in this section.
From this perspective, in compliance with the party-presentation principle (principio dispositivo), this Collegiate Panel shall analyze the claims at issue and the arguments that, in its judgment, support them, within the framework set forth above. -
Given that, in the complaint, counsel for the plaintiff sets forth a series of claims drafted in such a manner that each contains other related claims—that is, each claim comprises two or more consequential claims arising from one another—this Collegiate Panel, in order to conduct a comprehensive examination of the cause of action (causa petendi), shall distinguish, classify, and regroup them. Accordingly, the claims shall be analyzed in the following order:
As noted above, the plaintiff maintains that, while she was not residing on her property, on 15 de enero de 2004 the Municipalidad de Orotina, without her authorization, constructed and installed a stormwater and wastewater easement (servidumbre de aguas pluviales y servidas) within her property, running from south to north along the entire eastern boundary of that property (from front to back), and continuing toward the adjoining property to the north. She seeks a declaration from this Court that her property, recorded under real property folio registration N° 322557-000 of the Partido de Alajuela, is encumbered by “a water-conveyance easement (servidumbre de conducción de aguas).” As part of this claim, she requests that the judgment declare that the Municipalidad de Orotina was the entity that imposed that easement on her property. In response to these arguments, the defendant Local Government bases its defense principally on three grounds.
First, it contends that it was not the Municipalidad de Orotina that installed or constructed the pipeline located on the plaintiff’s parcel (predio), but presumes that it was the Instituto de Desarrollo Agrario (hereinafter, IDA), currently INDER, because that public entity owned the parent property (finca matriz) that was subdivided (fraccionada) and sold to the plaintiff; it therefore alleges a lack of passive standing (falta de legitimación pasiva). Second, it states that responsibility lies with the company or public entity developing a housing project—which, in this case, it maintains was disguised by IDA as an Agrarian Settlement (Asentamiento Agrario), although in practice it constitutes a Residential Development (Urbanización). In this specific case, the Municipalidad de Orotina did not develop the Settlement; rather, IDA did so and, moreover, failed to comply with the applicable procedures for approval of the site plan, or to obtain the municipal permits required for its construction.
Nor was the preliminary project submitted for its consideration, and the relevant matters were not coordinated with that Municipal Corporation, in support of which it cites a series of items of evidence. Finally, it asserts that the easement encumbering the plaintiff’s property constitutes a natural easement (servidumbre natural), to which the Ley de Aguas applies, and that, because it is located on a public road, the obligations contained in section 20 of the Ley General de Caminos Públicos concerning keeping the drainage system clean and operational also apply; accordingly, no compensation is due. COURT’S OPINION: This claim must be partially granted by this Contentious-Administrative and Civil Court of the Treasury, solely insofar as it seeks recognition that a water easement (servidumbre de aguas) is installed within her property. Nevertheless, the additional claims seeking a declaration that the Municipalidad de Orotina constructed it were not proven and must be denied.
Consequently, the defense of lack of passive standing raised by the defendant Municipalidad is partially upheld for the reasons outlined below. The evidence contained in the electronic judicial case file, together with the evidence received during the oral and public trial, establishes that the existence of a stormwater easement located along the eastern boundary of the property recorded under real property folio registration N° 322557-000 of the Partido de Alajuela, which is owned by Ms. [Nombre 002], is an undisputed fact. (See Proven Fact N° 15). It may even be inferred from the photographs included in the Expert Report submitted in this matter that this pipeline is exposed in certain places, particularly in the area adjacent to the dwelling constructed by the plaintiff. Eng. Luis Jonathan González Portuguez identified it during the Oral and Public Trial, allowing this Panel of Judges to confirm its existence.
In addition, the testimony of the witnesses who are municipal officials and who have been involved in the proceedings—Juan Pablo González Calderón, Javier Umaña Durán, and José Pablo Rojas—is also consistent regarding its existence within the plaintiff’s property. The Expert Report also establishes—and this aspect was not challenged by the representative of the Municipalidad de Orotina—that the easement has an area measuring 121 m2 in width and length and encumbers the 800-meter property acquired by the plaintiff in 1997. (See Proven Facts N° 3 and 15). What is considered disputed is the nature of that easement and the effects it has on the plaintiff’s substantive legal position (situación jurídica material). Therefore, before continuing with the analysis of the remaining claims, it is necessary to determine what type of easement is currently located within Ms. [Nombre 002]’s real property. i) General Aspects of Easements.
In this regard, the discussion must begin with the definition of an easement, an issue that may underlie the confusion arising from the claimant’s arguments and that, as indicated in advance, renders her claim for compensation untenable. In general, an easement, as a legal institution originating in civil law, may be understood as a “right in rem (derecho real) consisting of an encumbrance imposed upon one parcel for the benefit of another parcel belonging to a different owner” (Muñoz Machado (Santiago). Diccionario Panhispánico del Español Jurídico. España, Real Academia Española, Volumen I, 2017 p1890). Its nature as a right in rem means that it attaches as an indivisible part of the property, pursuant to section 224 in relation to sections 225 and 371, all of the Código Civil, the latter of which provides that “Easements are inseparable from the land to which they actively or passively belong.” Thus, the Sala Primera de la Corte Suprema de Justicia has specifically identified inseparability and indivisibility as characteristics of easements, stating that the former means that “they are indissolubly bound to the land to which they actively or passively belong; they are likewise indivisible, in the sense that even when the dominant estate (predio dominante) is divided, the easements remain intact and the new owners shall enjoy them without increasing the encumbrance on the servient estate (predio sirviente); and if the latter is divided, the easement remains, and each of the segregated parcels must bear the exercise thereof to the corresponding extent.
The Sala Primera de la Corte Suprema de Justicia so explained in ruling 017-F-99 at 14 hours thirty 5 minutes on 20 de enero de 1999, and likewise in ruling no. 750-F-2000 at 16 hours 30 minutes on 2 de octubre del 2002.” (See Resolution N° 120-2010 at 8:30 hours dated 19 de noviembre de 2010). In addition, section 370 of the Código Civil provides that easements encumber not persons but the real properties on which they are located, making them rights in rem. In the case at hand, the easement under examination is installed on the plaintiff’s private property, and the testimony received during the Oral and Public Trial from the Expert and the four witnesses consistently establishes that water originating from the residents of the Asentamiento "El Vivero" flows through it; that is, it serves a community interest (interés comunal)—a social interest consisting of the aforementioned Settlement—and forms part of its stormwater system.
A clarification is required here: although easements are rights in rem, this does not mean per se that they are intended to serve the objectives of a public entity. Rather, as noted, the easement serves a social interest (interés social), which is not equivalent to the interests of the State or of a Local Government; nor, as the Sala Constitucional has explained, does it have content comparable to the meaning of public interest (interés público). Thus, “Public interest is not the interest of a group of inhabitants viewed as a mass; it is not a general, omnipresent welfare or an indefinable happiness; it is only the sum of a majority of coinciding individual interests. Accordingly, the opposition between the public interest and individual rights is false unless it results in greater rights and benefits for the individuals within the community. We are, of course, referring to a majority of individuals, ‘or to all members of society.’ The interests must also coincide lato sensu; that is, they must be homogeneous.” (GORDILLO (Agustín).
Tratado de Derecho Administrativo y Obras Selectas, Argentina, Editorial Fundación de Derecho Administrativo, 2013, pág. 408). This is consistent with section 113 of Ley N° 6227, Ley General de la Administración Pública, which establishes principles directing public servants to act primarily in furtherance of the public interest, “(...) which shall be regarded as the expression of the coinciding individual interests of those subject to the administration.” That section likewise states that “in assessing the public interest, primary consideration shall be given to the values of legal certainty and justice for the community and the individual, over which mere expediency may under no circumstances take precedence.” (Emphasis not in the original). With respect to the concept of the social interest of property, the Sala Constitucional held in Resolution N° 000796-1991 at 15:10 hours dated 26 de abril de 1991 that: “The Constitution of 1949 did not expressly declare the so-called ‘social function’ of property, but it did retain the same concept of the social interest of property.
Considering both the period in which that rule was incorporated into our constitutional law alongside the social guarantees, and the reasons that prompted the reform and the meaning that legal literature had attributed to that expression in prior years, there can be no doubt that the concept is identified with the problems of social classes, particularly those with fewer resources, and with the measures that must be adopted to improve the economic conditions of those classes and to ensure that human coexistence is directed toward achieving the common good and social justice ...” Extraordinary session of the Corte Plena of 25 de marzo de 1983.- As can be seen, the Constitution uses the concept of social interest in a sense different from that of public interest, and it must be understood accordingly because the provision was introduced as section 29 of the Constitution of 1871, together with the reform that added the chapter on social guarantees to the Constitution in 1943, which is now section 45 of the Constitution.-” Thus, when reference is made to that social interest, it cannot be confused with the interests pursued by the Local Administration or with the burdens or limitations that may be imposed upon property for specific purposes, as the grounds of the complaint appear to suggest where they state: “(...) in the present case, it is evident that the defendant, in its capacity as a public institution, sought to provide an outlet for a water-disposal problem (...), by virtue of which it is obligated to obtain sufficient land for its construction and use.” This issue will be analyzed in greater detail below with respect to the nature of the easement, its purpose, and its effects on the property owned by the plaintiff. ii) Analysis of the Specific Claim.
Returning to the foregoing discussion regarding the social-interest purpose of the burdens and limitations (cargas y límites) that the law may impose on the fundamental right to property, this Chamber of Judges finds that this easement (servidumbre) serves the residents of Asentamiento El Vivero, where the waters flow through a series of ditches and stormwater structures that ultimately channel them into an inspection box located at the entrance to the property of Ms. [Nombre 002]. This social interest takes precedence over a private interest, since “(…) there is no merely logical possibility that unlimited rights may exist, because the very essence of the legal system is to establish a system of limits among the possessions of all persons, and an unlimited subjective right could cause the destruction of the legal order. (…) Thus, the view that property is absolute, as an unlimited and exclusive right affected only by grounds for expropriation to construct public works—the only limitation accepted in the last century—has been replaced by a new conception of property which, while continuing to be regulated as a subjective right, provides that its powers are limited and that it is also subject to duties and obligations.” (For further discussion, see Resolution N° 2007-006581 at 15:39 hours on 15 de mayo de 2007).
Nevertheless, the evidence submitted by the plaintiff does not establish that the Municipality constructed or developed Asentamiento "El Vivero," nor did she establish that the easement was created through the intervention of the Local Government. Indeed, no evidence was introduced to determine the specific date on which the easement was installed on the plaintiff’s property; therefore, she failed to demonstrate that the easement was constructed on 15 de enero de 2004. To prove these facts, the plaintiff offered the testimony of Mr. Luis Fernando Araya Arguedas; however, he was unable to identify specifically in his testimony the date on which the easement was constructed. In his testimony, he stated that he is the plaintiff’s neighbor and lives beside the property. He indicated that he could not state precisely the date on which he moved permanently into his house because, when the houses were delivered, basic utilities were not yet available and the houses were delivered incomplete.
He indicated that by the time he moved in, between 2002 and 2003, the streets had already been completed, although they were gravel roads. Now, although this witness stated orally in his deposition that the Municipality had constructed the easement at the plaintiff’s residence, when asked how he had reached that conclusion, he answered that it was because he had seen Local Government vehicles. However, he could not identify the persons who were carrying out the construction, even though he noted that he had worked for the Municipal Corporation years earlier. Thus, he was unable to determine from the surrounding circumstances whether the work involved creating the infrastructure that channels water through the easement or intervening in infrastructure that already existed. From this perspective, the judges comprising this Section find that the testimony of the aforementioned gentleman was based on assumptions; that is, he presumed that the Municipality installed the infrastructure on the plaintiff’s property, but he did not substantiate his statement as to manner and time.
Accordingly, the Court cannot deem it credible enough to establish with certainty the truthfulness of his statement. Furthermore, the party also failed to establish through other evidence, such as photographs or documents, that the Municipality constructed and installed the pipe used as a water easement (servidumbre de aguas). Rather, two matters cause this Court to doubt the Municipality’s involvement in installing that pipe. The first is that, as the Municipal Corporation demonstrated, it did not participate at any preliminary stage or during the development of Asentamiento "El Vivero," nor did that institution coordinate beforehand with the Municipalidad de Orotina at that time. This situation is established by the documents submitted by counsel for the defendant, consisting of plan N° A-331685-96, corresponding to Lot 27 of Proyecto "El Vivero," which constitutes property registered under real-property folio N° 322557-000 of the Partido de Alajuela, where it is expressly stated that the project belongs to the Instituto de Desarrollo Agrario, specifically to that public entity’s Dirección del Registro Pacífico Central (Proven Fact N°1), and the public deed executed at 10:00 hours on 21 de marzo de 1997, in which IDA appeared as the owner and seller of Lot 27 in favor of Ms. [Nombre 002] (Proven Fact N° 2).
The plaintiff introduced no rebuttal evidence regarding these facts. Nor did she offer evidence to rebut the fact that, in 1997, she received a housing grant for the construction of her house. This fact is vitally important because, although it was established that the building permits (licencias constructivas) were not obtained before her residence was constructed, the sketch contained in the Expert Report prepared by Eng. González Portuguez shows that the residence was built partly within the area of the water easement at issue in this litigation. Therefore, under the rules of logic set forth in section 16 of the Ley General de la Administración Pública, the residence was constructed after the pipe had been installed on her property, and not the reverse, as the complaint would appear to suggest. Another fact established is that, in 2007, the streets had not yet been transferred as part of the inventory of cantonal roads and that the urban development (desarrollo urbanístico) of "El Vivero" had not received any authorization or approval from, or been coordinated in any way with, the Municipalidad de Orotina.
This follows from the transcript of Agreement VI, Subsection 1, Part 2 of ordinary session N° 60 held on 02 de enero de 2007, appearing at images 187 through 193 of the electronic judicial case file (see Proven Fact N° 5), and also from official letter N° AT-560-2007 dated 31 de julio de 2007, signed by the Head of IDA’s Área Topografía and addressed to the then-Mayor of the Municipalidad de Orotina, in which he expressly stated: “As I mentioned to you at some point by telephone, the Executive Presidency of IDA delegated to me the task of coordinating with that municipality the identification and possible transfer of the roads located in 9 sectors (Cebadilla, Santa Rita, Cerro Bajo, Cerro Alto, Mollejones, Vivero, Huacas, Cámara, Los Mangos) of the Coyolar project administered by IDA. (…). In view of this situation, I am sending you copies of the mosaic plans for those sectors.” (See Proven Fact N° 6).
These facts are consistent with the testimony of Juan Pablo González Calderón, Javier Alberto Umaña Durán, and José Pablo Rojas González during the Public Oral Trial Hearing, where all of them established, with particulars as to manner, time, and place, that IDA had not coordinated beforehand with the Municipalidad de Orotina and that the procedures prescribed by the municipal legal framework for the development of Asentamiento "El Vivero" had not been followed, proving that the Local Government did not participate in the project’s preliminary stages. Accordingly, for lack of evidence establishing it, the claim that the Municipalidad de Orotina constructed or installed the water easement on the property owned by Ms. [Nombre 002] must be rejected. As indicated, the defendant Municipality’s defense of lack of standing to be sued (falta de legitimación pasiva) is therefore partially upheld, solely insofar as no evidence was introduced to establish with certainty that it was the entity that constructed or installed the easement on the plaintiff’s property.
In addition to the foregoing, in order to define the type of easement encumbering the plaintiff’s real property, the Court considers it relevant to determine the legal regime governing water easements in Costa Rica and, consequently, to analyze the claims for compensation (pretensiones indemnizatorias). iii) The water-easement regime under the Costa Rican legal system: Counsel for the defendant contends that the water easement on the plaintiff’s property is a natural easement (servidumbre natural), pursuant to article 94 of the Ley de Aguas, “insofar as rainwater, given the orographic and topographic conditions of the location of the plaintiff’s property, naturally and inexorably flows through that property (…). A simple visual inspection, as well as the technical evidence submitted with this brief, establishes that along the southern boundary of the plaintiff’s property, which is the public street created by the developer of Asentamiento ‘El Vivero,’ there is a natural slope descending from east to west, west to east, and south to north, with that property as the point where the flows converge, which means that the natural drainage outlet,” and subsequently asserts that it is “the owner’s duty, pursuant to section 20 of the Ley General de Caminos, when the owner’s lands are adjacent to a road’s drainage channels, to keep the drainage channels of a road that are adjacent to them clean, fully operational, and free of obstructions.” The claimant, in turn, asserts that the water easement on her property has not been recorded in the land registry.
THE COURT’S FINDING: With regard to these issues, there is evident confusion among the different types of easements that may be established over real property and the effects that they have on title to property. Accordingly, the Court will describe in general terms certain characteristics of easements, supplementing the discussion above concerning limitations on the right to private property, and will address the classification of the easement located within the real property registered under real-property folio N° 322557-000 of the Partido de Alajuela. The Código Civil provides that easements may be continuous and nonapparent (continuas no aparentes), continuous and apparent (continuas aparentes), or discontinuous (discontinuas); there are also natural, statutory (legales), voluntary (voluntarias), compulsory (forzosas), temporary (temporales), and perpetual (perpetuas) easements. Their legal effects depend on their nature, and the legal system governs the manner in which they are created.
For example, section 378 of the Código Civil provides that “Easements that are both continuous and apparent may be created by agreement, by last will, or by the mere use by one party and acquiescence by the other”; in contrast, “Discontinuous easements of every kind and continuous nonapparent easements may be created only by agreement or by last will. Possession, even from time immemorial, is insufficient to establish them.” The plaintiff is therefore incorrect in asserting that an easement must in every case be recorded in the Registro Nacional, since in some cases it may even be created by agreement between the parties or arise naturally or by operation of law. (For further discussion of the types of easements, see Resolutions N° 26 at 8:30 hours on 16 de marzo de 1991; N° 750 at 16:30 hours on 02 de octubre del 2002; and N° 00890-2006 at 10:00 on 10 de noviembre de 2006, issued by the Sala Primera de la Corte Suprema de Justicia).
There are also different purposes for easements (servidumbres); they may be railway, mining, oil, water, right-of-way, or electrical easements, among others, each of which has its own legal regulations. Accordingly, those regulations must be consulted to determine the dimensions, particular features, and effects that such easements have on private property. In the case of water easements (servidumbres de aguas), such as those described in the allegations of the complaint, reference may be made to two legal provisions regulating them: the Ley de Aguas and the Ley General de Caminos Públicos. The first statute provides for two types of easements: natural easements (Articles 94 to 98) and statutory easements (servidumbres legales) (Section II, Articles 99 et seq.). Article 94 of the Ley de Aguas expressly regulates natural easements as follows: “Lower-lying lands are required to receive water that flows naturally, and without human intervention, from higher lands, as well as any soil or stones carried along its course.
However, if the water is the product of artificial extraction, surplus water from irrigation ditches, or water originating from industrial facilities that have not acquired this easement, the owner of the parcel receiving the water shall have the right to demand compensation for loss and damage, unless that owner wishes to make use of the water received by the land, in which case there shall be no right to such compensation. (…)” As is apparent from the plain wording of the quoted provision, a natural easement shall be deemed to exist when there has been no human intervention and the water flows over a specific property as a result of the natural forces or topography of the land, meaning that its owner must tolerate it. However, according to the holding of the First Chamber of the Supreme Court of Justice, with which this Court agrees, in Decision No. 890-2006 at 10:00 a.m. on November 10, 2006, “what is prescribed in that article is an easement imposed by operation of law”; therefore, it does not confer any right to compensation, nor does it require the Administration to expropriate the property.
As for the provisions of the Ley General de Caminos, hereinafter abbreviated as LGC, Article 20 provides: “All possessors of real property, under any title, are required to receive and allow water from roads to flow through their parcels when so dictated by the slope of the land and, when their properties are adjacent to road drains, they must keep those drains clean, in perfect working order, and free of obstructions. If this obligation is not fulfilled, the Ministry or the Municipalities shall order the work performed and shall charge the cost of the work plus a fifty percent (50%) surcharge. The Ministry of Public Works and Transportation and the Municipalities shall coordinate with the Ministry of Agriculture regarding measures to protect roads in new-route projects or maintenance work on existing routes in regions where those routes may cause or intensify erosion or divert the natural drainage of the fields.” Three points may be inferred from the plain wording of that provision: first, they must be easements through which water from public roads flows; second, the water must flow naturally according to the slope of the land; and third, the properties must be adjacent to the road drain.
In this specific case, the water easement resulted from human intervention because it was created through the development of Asentamiento "El Vivero" (see Proven Fact No. 2, which states that IDA, now INDER, consolidated the land and subsequently subdivided it and conveyed it through the sale of lots to several individuals, including Ms. [Name 002]). Moreover, because it fronts a public street (see Proven Facts Nos. 1 and 2 in relation to Proven Facts Nos. 11, 14, and 15), it follows that this is not currently a natural easement regulated by the Ley de Aguas, but rather a statutory public-road easement regulated by the LGC. This does not imply a denial of the prior existence of a natural water easement, because the evidence introduced into the court record shows that the downward slope from the southern boundary toward the northern boundary of the plaintiff’s property existed previously, according to the testimony of Mr.
Jose Pablo Rojas González, a Land Surveying Engineer, whose testimony this Panel of Judges finds persuasive, spontaneous, and credible. In the following section, we will analyze those three criteria as applied to this specific case. iv) Analysis of the nature of the water easement located on the plaintiff’s property. To support this Panel of Judges’ determination regarding the classification of the easement at issue in these proceedings, the Court will analyze the three aforementioned points derived from Article 20 of the LGC, as summarized above. a) It was stated that the easements must carry water from public roads. As noted above, the southern side of the plaintiff’s property borders a public street, as evidenced both by registered survey plan No. A-331685-96 for the plaintiff’s property and by the verbatim certification of property recorded under real-property folio No. 322557-000 of the Alajuela Registry District (Proven Facts Nos. 1, 2, and 3).
The easement begins at that southern boundary, where the inspection chamber (caja de registro) is located in front of the plaintiff’s property, as may be inferred from the Expert Report prepared for this specific case and the testimony of the appointed Court Expert. (See Proven Facts Nos. 14 and 15.) It was also demonstrated in this case that the public street in front of the plaintiff’s property is municipal property, according to the inventory prepared in 2007 by the Municipal Corporation (see Proven Fact No. 18). Thus, the municipality’s contention that the Asentamiento "El Vivero" project has not been “formally” transferred cannot be understood as applying to its streets or roadways. This is because, upon its incorporation into the cantonal road network, under the principle of first registration (principio de inmatriculación), the roadway—and its associated structures, including gutters and the entire stormwater system—came under the administration of the Local Government.
Therefore, under the classification set forth in Article 1 of the Ley General de Caminos, it forms part of the cantonal road network, the administration of which is entrusted to the Local Government, thereby satisfying the first criterion established in that statute. b) Another requirement under the quoted provision is that “the properties must be adjacent to the road drains,” which is also corroborated by the evidentiary materials introduced by the parties in these proceedings. In this regard, the testimony of all four witnesses was consistent that water from Asentamiento "El Vivero" flows along the public streets toward the plaintiff’s property, entering through the inspection chamber in front of her property. This is also consistent with the Court Expert’s testimony received during the Oral and Public Trial and shows that the chamber is not disconnected from the site’s stormwater system, because, according to the municipal surveyor’s testimony, the channeled water flows through the rear parcel adjoining the plaintiff’s land, where it reconnects with another section of the stormwater system before ultimately discharging into a body of water (a stream (quebrada)).
The sketch prepared by the Court Expert establishes the existence of an inspection chamber which, as indicated above, is located on the public street at the southern boundary of the plaintiff’s property (see Proven Facts Nos. 15 and 16). Even the closing arguments presented by both parties during the Oral and Public Trial agree that water originating from Asentamiento "El Vivero" flows toward the plaintiff’s property, and Mr. Luis Fernando Araya Arguedas, the plaintiff’s neighbor, referred to the existence of that inspection chamber, demonstrating that it is adjacent to her property. This element, established by the statute as necessary for the existence of a statutory easement under Article 20 of the LGC, is therefore corroborated. c) The other element is that the drainage must be “dictated by the slope of the land,” which was proven in this case. This conclusion follows from the results of the Expert Report submitted on October 10, 2022, by the appointed Court Expert, Engineer González Portuguez.
The sketch included in that report shows that the plaintiff’s property, recorded under real-property folio No. 322557-000 of the Alajuela Registry District, slopes downward from south to north. The elevation in front of the plaintiff’s house, at the public street, was determined to be 99.14, while the rear of her property is at an elevation of 96.767. There is therefore a downward slope, with the front portion being higher than the rear of the property owned by Ms. [Name 002] (see Proven Facts Nos. 13, 14, 15, and 16). This is also established by the testimony given by Mr. Javier Alberto Umaña Durán and Mr. José Pablo Rojas González during the Oral and Public Trial, which was consistent and spontaneous. Although they indicated that the difference in elevation was greater than that identified by the Court Expert, their testimony nevertheless confirms the existence of a downward slope from the other cardinal directions toward the plaintiff’s property.
Mr. José Pablo Rojas González, a Land Surveying Engineer with the Municipalidad de Orotina, also explained generally that they had conducted a topographic survey of the area to determine the contour lines in relation to the streets and gutters of Asentamiento "El Vivero". He stated that there are several inspection chambers there. They took measurements from the chamber in front of the plaintiff’s property, using contour intervals of every 25 centimeters, toward the next inspection chamber located in a south-to-north direction from that property, and determined a difference in elevation of 6.62 meters relative to the next street. The result is that the inspection-chamber infrastructure located in front of Ms. [Name 002]’s property is at the lowest point, and therefore all water from the public roads and gutters naturally flows toward the inspection chamber in front of the property recorded under real-property folio No. 322557-000 of the Alajuela Registry District.
In response to this Court’s question, he stated that the problem affecting the disputed property is precisely that the contour lines across the entire property slope downward from the public street, such that water from the southern, eastern, and western boundaries of the plaintiff’s property converges at the inspection chamber in front of it. This condition arising from the property’s morphology is consistent with the information recorded in the contour map prepared in November 2021 by the Municipalidad de Orotina, which appears in the supplementary folder of the court record and was reviewed by this Court. The aforementioned Municipal Land Surveying Engineer further informed this Panel of Judges during the Oral and Public Trial that they used as source materials the 1987 contour lines, which show a difference in elevation similar to that identified by the topographic survey performed.
In parallel with the foregoing, it was also demonstrated that the Municipalidad de Orotina performed a series of maintenance works on the streets, gutters, and inspection chambers of the Asentamiento "El Vivero" (See Proven Facts N° 11 and 12). However, the municipal officials admitted as witnesses stated that those works were based on the terrain’s existing morphology, specifically the infrastructure already present at the site, and did not alter the site layout and design established by the developer; rather, maintenance and improvement works were performed using the existing conditions as their starting point. In view of the foregoing, compliance with the third criterion established in section 20 of the Ley General de Caminos is confirmed, and it is therefore concluded that this is the provision applicable to the specific case. Continuing this discussion in order to analyze the claims (pretensiones) asserted by the respondent (accionada), the application of this provision to the specific case entails two relevant aspects: first, the obligation of the owner of the servient estate (fundo sirviente) through which water from public streets flows to keep these drains (desagües) clean, fully operational, and free of obstructions.
Second, they have a legal duty to bear that burden, which precludes the payment of any compensation on account thereof. Thus, the Sala Primera de la Corte Suprema de Justicia has held that the discharge of water (desfogue de las aguas) must be borne, provided that the flow is reasonable (See Resolution N° 00297-2017 at 15:40 hours on 16 de marzo de 2017), by virtue of the aforementioned social function of property (función social de la propiedad), and because a legal provision establishes that burden. This issue will now be examined in greater depth in relation to the remaining claims. - 3. REGARDING THE CLAIM FOR A DECLARATORY JUDGMENT (PRETENSIÓN DECLARATIVA) CONCERNING THE FAILURE OF THE MUNICIPALIDAD DE OROTINA TO COMPLY WITH THE EXPROPRIATION PROCEDURE (PROCEDIMIENTO DE EXPROPIACIÓN) AND THE CORRESPONDING PAYMENT OF JUST COMPENSATION (JUSTIPRECIO).
As previously stated, the principal claim for compensation is based on the existence of an omission by the defendant Local Government, consisting, in Ms. [Nombre 002]’s view, of its failure to expropriate the strip of her property burdened by the water easement (servidumbre de aguas), as well as to compensate for the damage caused to the remainder. In the brief dated 03 de setiembre de 2021—in which the facts alleged in the complaint were amended—she states: “In connection with the creation of this easement (servidumbre), the MUNICIPALIDAD DE OROTINA took no steps whatsoever to conduct the required expropriation proceeding (proceso expropiatorio), which it was legally required to carry out; nor did it request permission, much less pay the value of the land actually occupied and affected. (…) the defendant has violated due process and infringed Article 45 of the Constitution, the Ley General de Expropiaciones, and the Ley General de la Administración Pública.” She continues by arguing that the State is required to answer for the damages (daños y perjuicios) that may be caused by each and every one of its acts, and that this liability is strict liability (responsabilidad objetiva), quoting Articles 9 and 41 of the Constitución Política and sections 190 and 191 of the Ley General de la Administración Pública, and stating that the State’s civil liability arises irrespective of whether the public official acted negligently or intentionally.
She then refers to section 1048 of the Código Civil and, to establish how this liability applies to the specific case, states that the Local Government, in seeking a solution for the disposal of the water, decided to construct the easement on her property, “by virtue of which it is obligated to secure sufficient land for its construction and use, because it does not maintain it, which entails the imposition of a series of restrictions on building, accumulating materials, planting trees, or obstructing the strip of land it encompasses; a situation that constitutes a significant limitation on the essential attributes of ownership because it prevents me from freely using and disposing of my property.” She cites section 45 of the Constitution and section 13 of the Ley de Expropiaciones. THE COURT’S POSITION: Returning to what has been maintained throughout this decision, there is no question as to the inviolability of private property, understood as “the right exclusively to possess a thing, enjoy it, and dispose of it, subject only to the limitations established by law or by the owner’s will.” (Ver Resolución N° 2006-017514 de las 9:41 horas de fecha 01 de diciembre de 2006 emitida por la Sala Constitucional de la Corte Suprema de Justicia).
It is also recognized, and this Court agrees, that: “The protection of rights in rem (derechos reales) in civil and agrarian matters is of great importance in all legal systems that have consolidated a constitutional foundation firmly rooted in the protection of fundamental human rights: alongside rights of economic freedom, which include private property and the other derivative rights in rem, economic, social, and environmental rights and duties have also been enshrined. Private property and economic freedom are constitutionally protected under Articles 45 and 46 of our Carta Magna and, although it may seem obvious, their existence and protection stem from the continued existence of a Social State governed by the rule of law (Estado Social de Derecho), based on constitutional principles and values that enshrine not only rights in favor of private individuals but also duties intended to achieve economic development with equity, solidarity, and social justice.” (Ver Sala Constitucional Resolución Nº 16629 -2012 a las 16:31 horas 28 de noviembre del 2012).
Nevertheless, it must not be overlooked that the legal system as a whole establishes a balance between the rights of individuals subject to the Administration, the safeguards established to protect the system of freedoms—which, as stated above, include the fundamental right to “have” (private property)—and the general and public interest and the social function of property itself, which entails bearing non-compensable burdens. The Court also reiterates the point already made that, for these reasons and because of the evolution of the concept of property itself, property may legally be subject to burdens, limits, or restrictions that encumber real property, some of which must be borne by the owner without entitlement to compensation, as is the case with statutory easements (servidumbres legales). Without seeking to examine the subject in depth, the case law of the Sala Constitucional and the Sala Primera de la Corte Suprema de Justicia has determined that the imposition of statutory easements, such as the one provided for in section 20 of the Ley General de Caminos Públicos—the provision governing the easement crossing the plaintiff’s property—has a historical basis as part of the dichotomy between ideological views concerning the content and scope of private property.
Accordingly, the Court quotes the following, somewhat lengthy, position adopted by our Constitutional Court regarding statutory easements: “Notwithstanding the foregoing, although the origin of its provisions reflects two different and apparently conflicting ideological orientations, Article 45 of the Constitución Política de mil novecientos cuarenta y nueve must be read, interpreted, and applied as an integrated whole, based on the new orientations and schools of legal thought. Thus, when the first paragraph establishes that ‘property is inviolable,’ it cannot be understood as defining the concept of absolute and untouchable property advocated and supported by the ideology of economic liberalism, under which property was conceived as an institution of natural law insofar as it was understood to be an extension of the personality, since it is the individual who fulfills its social function, meaning that each individual owns the utility and benefit of his or her property; that is, in order to develop all of his or her faculties, a person must exercise dominion over the external world and use and appropriate the things required to achieve that objective.
Indeed, based on this conception, it was regarded as one of the most significant rights during the first stage of constitutionalism—as a first-generation right—and became the quintessential right in rem, insofar as all other rights are merely emanations from it, partial forms of ownership that are incapable, by themselves, of providing the full enjoyment thereof. For that reason, legal scholars defined it as ‘the right by virtue of which a thing is made absolutely and exclusively subject to the will and action of a person.’ Within this ideological framework, limitations on political freedom are legitimate, but limitations on economic or entrepreneurial freedom are not. This concept originated in Roman law, which defined it as the right to obtain from an object all the satisfaction that it can provide, extending from the subsoil—‘usque ad inferna’—to the airspace—‘usque ad coela.’ The only limitations permitted were ‘statutory easements,’ which entailed tolerating or refraining from an act, such as rights of way or the collection of fallen fruit, as well as the basic restrictions of planning law, most of which are included in our Código Civil; for example, those concerning the possession and transfer of real property—Article 272—which prevent partition in cases of co-ownership; those concerning the height of sidewalks—Article 303; those establishing protection against possible harm caused to third parties by buildings or trees in poor condition—Article 311; and, in particular, all of Title V, entitled Burdens or Limitations on Property Imposed by Law, which establishes, among others, prohibitions against constructing wells, sewers, aqueducts, and similar works near a party wall—Article 404—and prohibitions against opening a window or skylight in a dividing wall at a distance of less than two and a half meters—Article 406—or where they overlook rooms, courtyards, or livestock enclosures on neighboring property—Article 407.” (Ver Resolución N° 2007-006581 de las 15:39 horas de fecha 15 de mayo de 2007 de la Sala Constitucional).
In this context, what follows from the plaintiff’s arguments and corresponding claim for compensation is, first, that she fails to recognize that the easement on her property is statutory in nature and, second, that she seeks compensation through expropriation (expropiación), while also confusing the scope of expropriation with the circumstances under which a restriction, limit, or burden on property legally deprives the property right of its substance, in which cases compensation is indeed required. Accordingly, the Court considers it appropriate to distinguish between these two legal mechanisms.
Because easements have already been briefly analyzed as rights in rem of enjoyment (derechos reales de goce), the Court will now briefly describe the institution of expropriation. In its first section, the Ley de Expropiaciones provides a series of guidelines concerning expropriation and its legal framework, stating: “This law governs compulsory expropriation for a legally established public interest. Expropriation is ordered in the exercise of the sovereign authority of the Public Administration and encompasses any form of deprivation of private property or of legitimate property rights or interests, regardless of their holders, upon prior payment of compensation representing the fair value of the property expropriated.” (Emphasis not in the original). It bears repeating that the Sala Constitucional and Costa Rica’s constitutional and statutory legal framework are very clear that the law may establish a series of limitations on property provided that “the property is not subjected to divisions that extinguish the right, since the natural use of the property and its economic market value are preserved.
It is also clarified that limitations or restrictions on property are general in nature and have the virtue of providing individuals with the instruments necessary to mitigate the effects of harmful activities by their fellow citizens. It should be noted that their purpose or objective is the rational use of property, thereby benefiting neighbors or society as a whole; this obligation is grounded, by way of justification, in the understanding that such limitations are essential for coexistence in society and do not constitute an expropriatory measure requiring prior compensation under the terms required and provided for in the first paragraph of Article 45 of the Constitución Política.” (Ver Resolución N° 2007-0006581 de las 15:39 horas de fecha 15 de mayo de 2007, ya citada).
From the foregoing, it may be inferred, very briefly, that expropriation (expropiación) “per se” entails deprivation of private property or of the rights associated with it, such as the use or enjoyment of the thing. This is precisely what we described above as an inviolable boundary on the imposition of an encumbrance, restriction, or limitation: the right to property must not be deprived of its substance. When the limitation is of such magnitude, whether because of its content or duration (such as the temporary encumbrance of property, which the Constitutional Chamber has held constitutes a freezing that must be compensated; see Resolution N° 2007-005598, issued at 15:47 hours on 25 de abril de 2007), it entails a greater burden and an imbalance between citizens’ rights and guarantees and the powers of the State (even where supported by a public interest; indeed, the existence of a public interest is assumed as a prerequisite for State action).
The situation therefore constitutes an expropriatory act that deprives the owner of the property, and consequently gives rise to a duty to provide compensation. The claimant’s theory of the case confuses the first paragraph of constitutional Article 45 with its second paragraph; the two contain different rules. The first paragraph governs the complete deprivation of property or of the rights held by the owner of an asset, whereby, following a determination that a public interest permits it, a private party is dispossessed of the asset so that it may be transformed into another asset intended to serve the general public interest. The second paragraph provides for the social function of property (función social de la propiedad) and the possibility of establishing restrictions and encumbrances, whose validity or legitimacy arises “when necessary to make possible ‘the continued force of democratic and constitutional values’; accordingly, in addition to being useful, it must be necessary, reasonable, and timely, and must entail the existence of a compelling social need supporting it and must therefore be exceptional; consequently, such restrictions must be intended to satisfy an imperative public interest.
The reasonableness of the limitation lies in its suitability for the purpose and interest (value) that justify it; and f.- Limitations are not compensable insofar as they do not entail severances that cause the right to disappear; compensation is provided solely to address the loss of property (expropriation).” (See the previously cited Resolution N° 2007-006581 of the Constitutional Chamber). The deprivation of property alleged by the claimant has not been demonstrated in this case. It may therefore be stated at the outset that both the request that an expropriation proceeding be conducted and the request for payment of fair compensation must be rejected. The error underlying the claimant’s theory of the case is the assertion that the mere imposition of an easement (servidumbre) constitutes a limitation that prevents her from using and enjoying her property and deprives her property right of its substance.
The mere imposition of the easement by law does not have that effect. As repeatedly stated in this analysis, it must be established that the easement is of such magnitude that it prevents the free use and enjoyment of the property. The claimant, who bears the burden of proof (Article 41.1 of the Code of Civil Procedure, a civil-law provision applicable to this specific case under Article 220 of the CPCA), has not demonstrated this. As previously noted, a party asserting a claim (pretensión) must prove the constituent elements of its right by introducing evidence into the proceedings to demonstrate that its property right has been deprived of its substance. There is no evidence whatsoever in the case file capable of substantiating the claimant’s assertion. Indeed, it should be noted that the claimant spontaneously states—which constitutes conclusive evidence under Article 41.3 of the Code of Civil Procedure—that the easement has a continuing effect and has been in place for 17 years.
The claimant has been living in her dwelling (without specifying a date), and the easement has not prevented her from using it as a residence, which is the purpose for which she has been using it. She further states that she is subject to a number of restrictions “on building, stockpiling materials, planting trees, or obstructing the strip of land it encompasses.” She argues that this constitutes a significant limitation on the essential attributes of ownership because it prevents the free use and disposition of the property. However, it has not been proven that these restrictions entail “a significant limitation on her property,” or that the obligations arising from the easement are disproportionate or unreasonable. The Court therefore does not agree with the claimant’s assertion that the Municipality is obligated to expropriate the easement. In other words, no abnormal omission by the Municipal Corporation in failing to carry out the required expropriation proceedings has been established.
As stated above, the easement encumbering the claimant’s property is a statutory easement (servidumbre de carácter legal), and she has not demonstrated that it deprives her right as owner of its substance or severs that right—an issue the claimant was required to prove. Moreover, as previously stated, within the 121 m2 area of the easement, the Expert Report submitted by Mr. Luis Jonathan González Portuguez identifies a section of the easement that was originally underground, above which her residence was built. This evidence was not rebutted by the claimant, and this Panel of Judges cannot determine the nature of the encumbrance that allegedly prevents her from using and enjoying her property in such a way as to produce, as she claims, “an egregious limitation.” Indeed, as has been explained: “The imposition of an administrative easement does not produce any alteration in the owner’s legal status: the owner remains the owner and may use the thing, but must respect the established easement without violating the obligations imposed by law.
(…) We emphasize that the imposition of an administrative easement (or a civil easement, since they do not differ in this respect) on private property does not deprive the owner of the use of the thing; rather, it requires the owner to tolerate its concurrent use by the public authority and to use it personally in accordance with the conditions imposed by law. If an attempt were made to establish an ‘easement’ that completely deprived the owner of the use of the thing, transferring it entirely to public use, it would in fact constitute an expropriation rather than an easement.” (Gordillo (Agustín). Administrative Law of the Economy. Buenos Aires, Argentina, Ediciones Macchi, Volume XVIII. 1967, pp. 376 and 377). To establish that the measure is not an easement but instead, by virtue of its effects, implicitly entails an expropriation, the party making that allegation must prove it with evidence satisfying the requirements established by the applicable legislation, namely, that it be appropriate, useful, and necessary (Article 41.3 of the Code of Civil Procedure).
This Court finds such evidence lacking, which supports dismissal both of the claim for a declaration that the Municipalidad de Orotina failed to conduct the expropriation proceeding for the strip of land on which the easement is located and of the claim for the corresponding compensation for that restriction or encumbrance established by the legal system (Article 20 of the Ley General de Caminos Públicos).
II.On the distinction between administrative liability (responsabilidad administrativa) and expropriation. Another ground put forward by Ms. [Nombre 002] in the complaint is that the Municipality bears patrimonial liability (responsabilidad patrimonial), for which she cites Articles 9 and 41 of the Constitución Política and Articles 190 and 191 of the Ley General de la Administración Pública. However, this argument assumes that fair compensation (justiprecio)—that is, the amount paid by the Administration as a result of an expropriation—is equivalent to the compensation provided for in the Ley General de la Administración, which is incorrect. As a preliminary matter, the Court agrees with the claimant’s position that, pursuant to the previously cited case law issued by the First Chamber of Justice, it has been established that, in Costa Rica, Article 41 of the Constitución Política, in conjunction with constitutional Articles 9, 11, and 33, creates a predominantly strict-liability regime for the State, under which the entire system is shifted in favor of the individual subject to the Administration (administrado).
The individual is no longer required to prove subjective elements attributable to the public official in order to obtain compensation for public conduct that caused harm; instead, the burden of proof now rests on the Administration, which must exonerate itself in relation to the facts attributed to it. Thus, “Whenever an injury has been suffered as a consequence of public conduct, whether by act or omission, which the person has no duty to endure, the duty to provide compensation arises by virtue of the principle of full reparation for harm derived from Article 41 of the Constitución Política.” (First Chamber of the Supreme Court of Justice, Resolutions N° 138, issued at 15:05 hours on 23 de agosto; N° 192, issued at 14:15 hours 1 on 06 de noviembre, both of 1991; N° 48, issued at 14:10 hours on 29 de mayo de 1996; and N° 55, issued at 14:30 hours on 4 de julio de 1997). However, the application of the constitutional principle of full reparation for harm is neither unrestricted nor unlimited, nor does it apply automatically in every situation in which an individual subject to the Administration suffers an injury.
It is necessary to establish, on the one hand, the existence of financial loss or non-pecuniary injury and, on the other, a causal nexus (nexo causal) between the alleged harm and the Administration’s conduct, whether by act or omission. With respect to the causal nexus, it has been stated that: “Having established in this case the abnormality and unlawfulness of the omission, it remains to be determined whether that inaction was or was not the cause of the injury claimed, (…). This is because the occurrence of harm alone is insufficient to give rise to a duty to provide compensation; it is also necessary for that effect to have been caused by an act or omission of the State. Put more simply, attributing liability to the Administration requires harm, administrative action or inaction, and a causal nexus between the two. Once that relationship has been demonstrated, the duty of full reparation derived from Article 41 of the Constitución Política arises immediately.
In this regard, it should be noted that the occurrence of harm generally results from a combination of events and factors that caused it to varying degrees. Among these, it is imperative to establish which directly or indirectly constituted the adequate and efficient cause of the harm that arose. Regarding proximate, adequate, and efficient cause, reference may be made to this Chamber’s Judgment no. 252-F-01, issued at 16 hours 15 minutes on 28 de marzo del 2001. Within this combination of factual or legal elements surrounding the harmful situation, it will be necessary to identify the act or omission capable of producing the consequence, excluding those that had no influence whatsoever on the result (external causes), as well as those whose absence would have prevented the loss.” (First Chamber of the Supreme Court of Justice, Resolution N° 0074-F-2007, issued at 10:15 hours on 02 de febrero de 2007).
However, as we have seen, first, the limitation affecting the claimant’s property in this case does not have expropriatory effects. Accordingly, no breach of any legal obligation can be inferred, thereby breaking the causal nexus between the omission she alleges and the harm caused.
Secondly, any administrative liability (responsabilidad administrativa), had it been determined that there was a situation depriving her right of its substance—which, it bears repeating, does not occur in practice—would not result in compensatory relief based on liability; rather, the effects of expropriation (expropiación) are different. Indeed, “Expropriatory action (actividad expropiatoria) is aimed at depriving a particular person, in whole or in part, of a right or legitimate interest (interés legítimo), through the corresponding compensation or payment of fair value (justiprecio), in order to meet public needs. It follows that a specific and individual burden is imposed on the person whose property is expropriated, a treatment not imposed on other persons. (…) It is important to note that GIANNINI has termed ‘real measures of compulsory deprivation’ (medidas ablatorias reales) those adopted by public authorities to further the general public interest.
Such measures include expropriation, easements (servidumbres), compulsory sales and exchanges, and measures specific to land-use law (derecho urbanístico), such as imposing on a person the obligation not to build on property that he or she owns because it has been incorporated into the cultural heritage. Administrative liability, for its part, means that the public entity is required to compensate private parties, by way of compensatory reparation—and no longer as fair value—for damage caused by its normal, abnormal, lawful, or unlawful operation. Compensation (indemnización) is a mechanism created by law to compensate a person for damage inflicted by a particular administrative act or omission. It must be borne in mind, however, that damage resulting from non-contractual administrative liability (responsabilidad administrativa extracontractual) does not always translate into a social benefit for the community, as occurs with expropriation ordered on grounds of public interest.” (Rojas Morales (Iris Rocío).
Derecho Urbanístico Costarricense. San José, Costa Rica, Editorial Investigaciones Jurídicas S.A., 2010, pp. 461 and 462). Accordingly, the two concepts cannot be equated. Fair value, as its name indicates, is the payment received; it is the monetary restitution value for the taking of property by the Administration so that it may be transformed or devoted to a public purpose. In other words, it is payment for the acquisition carried out, and therefore that amount must be reasonable and proportionate; it must be equivalent, reasonable, and proportionate so as to allow the natural or legal person to obtain redress or compensation for the full value of the expropriated property. Thus, the respective terms—liability and expropriation, compensation and fair value—are not equivalent or synonymous, as the plaintiff erroneously contends, and consequently this argument must also be rejected. It also bears noting that the plaintiff did not assert a claim seeking a determination of the predominantly strict liability (responsabilidad preeminentemente objetiva) of the respondent Local Government, but instead linked it to expropriation and her right to compensation.
Because the preceding section established that the expropriation procedure (procedimiento expropiatorio) does not apply in this case, no right to any payment (payment of fair value) arises, and such payment cannot be confused with strict liability (responsabilidad objetiva). The following claims are therefore denied in their entirety: “- That it be declared that the Municipalidad de Orotina failed to comply with the due administrative process (debido proceso administrativo) for expropriation and compensation in favor of the owner of the property registered in the Partido de Alajuela, Folio Real number 322557-000, by reason of the establishment of a water easement (servidumbre de aguas) on that property. - I request that the respondent be ordered to pay for the land area comprising the easement, to pay for the damage to the remainder of the property, to pay the indexation (indexación) to which I am entitled, and to pay statutory interest (intereses de ley), which must be calculated from the date possession of the land was taken, namely, from January 15, 2004 until the date the established amount is actually paid; such interest shall be calculated on the amount of compensation and in accordance with the interest rate on 6-month certificates of deposit issued by Banco Nacional de Costa Rica.” It should also be mentioned that the plaintiff did not submit evidence demonstrating what the “damage to the remainder” alleged in the second claim consisted of or from what it arose.
Under section 58(e) of the CPCA, she was required to specify what the damage consisted of and from what it arose. Nor did she establish a causal link (nexo de causalidad) between any conduct (whether by omission or commission) of the Municipalidad de Orotina in the terms alleged and what was described as “damage to the remainder of the property.” Neither the complaint nor the evidence submitted reveals or establishes how the remainder is affected by the easement imposed by law. In this regard, it should be noted that the easement covers 121 m2 (See Proven Fact No. 16), whereas the plaintiff’s entire property measures 800 m2 (See Proven Facts Nos. 1, 2, and 3). It follows that the portion on which the easement is located does not render the remainder of the property unusable; that is, 679 m2 remain unencumbered and available for their intended use as a family residence. Nor does this demonstrate any impairment of the remainder, much less any damage, which Ms. [Nombre 002] has likewise failed to prove.
Indeed, as the court-appointed expert states, the plaintiff herself is using the area as a residence, without any specification of how the very existence of the easement affects the remainder of her ownership rights, without prejudice to what will be stated infra regarding the functionality of the easement. Accordingly, her claim for payment of damage to the remainder of the property resulting from that easement is likewise denied. The claim for indexation of the compensation amount and statutory interest meets the same fate because, as noted, those items are predicated on the principal claim that it should be determined that the property had to be expropriated and the corresponding amount paid. Because that claim has been rejected, under the general principle of law that an ancillary claim follows the fate of the principal claim, these items for indexation and payment of interest must also be rejected.
As to these two claims, therefore, the defense of lack of legal entitlement (falta de derecho) asserted by the respondent Local Government is sustained. - 4. REGARDING THE CLAIM SEEKING “REPAIR OF THE EASEMENT”: Lastly, Ms. [Nombre 002] sought an order that “(…) the Municipalidad de Orotina be ordered to repair the water easement (servidumbre de aguas) introduced onto my property and continue channeling it so that the water flowing through it is removed from my land along the northern boundary of my property, until the water is properly and effectively conveyed to a safe location.” In this regard, although this claim has been titled “repair of the easement,” it is considered that the relief sought includes requiring the Municipal Corporation to perform work intended to ensure that the water flows through a channel to its final destination, which would be the nearest body of water. For its part, the Municipality stated in its defense that: “(…) it has no authority to enter private property, much less to invest in stormwater and/or sewage, [which] constitutes part of the obligations of the creator or developer of a multiple-subdivision project (proyecto de fraccionamiento múltiple) which, as in the case of the ‘El Vivero’ settlement, had as its objective an urban residential use for the lots, particularly the claimant’s lot.” The foregoing was asserted to establish that it is prohibited from investing public resources within the claimant’s property.
Later, specifically in its response to the Eighth Allegation of the complaint, it stated that: “(…) if the easement (…) were causing problems involving blockages, inadequate channeling, or flooding, the problem should be analyzed so that the parties involved, particularly the affected property owners, with the support of the Municipalidad de Orotina and other competent institutions, may diagnose the causes and identify solutions, all within the applicable legal framework,” but it asserts that this does not create an obligation to expropriate, as claimed by the plaintiff. THE COURT’S ASSESSMENT: Regarding the operation of the easement located on the claimant’s property, this Judicial Body considers it undisputed that the culvert and the stormwater system (sistema pluvial) of the “El Vivero” Settlement are experiencing a series of problems. The principal factor appears to be that, given the manner in which the system was designed by a third party that was not the Municipality—and there is no evidence that the Municipality participated through acts authorizing or approving the design of the works—the stormwater system lacks adequate capacity, for reasons that were not brought into this proceeding but which the Municipality itself has acknowledged, and concerning which the municipal-employee witnesses agreed that the stormwater system was deficient.
Of particular note is the testimony of Mr. Javier Alberto Umaña Durán, who, in response to this Court’s inquiry, stated that the culverts had collapsed because the channels are narrow and therefore cannot be cleaned, and because the site’s design included culverts that are too small. However, judicial expert González Portuguez and the witness offered by the claimant, Luis Fernando Araya, together with José Pablo Rojas González and Javier Umaña Durán, also stated during the Oral and Public Trial that other elements in the area have obstructed the outflow and damaged the culverts, and that any foul odors are caused by the residents themselves, who deposit garbage that then flows through the channeling areas, gutters, and culverts. (Proven Fact N° 17). The dispute, then, is this: which natural or legal person must invest in remedying this situation? The Municipality contends that this is a private matter, particularly if discharged water (aguas vertidas) is flowing through the system, and that the cost of the repairs is very high and would prevent it from fulfilling other obligations in the Canton, a point also made in the testimony of the aforementioned public official, Rojas González.
It was also established that the Municipality had at one point considered modifying the water outflow crossing the property, an option it rejected “(…) because it is located at the lowest point of the street and is the drainage point created by the developer of the residential development; therefore, diverting the current course of the stormwater, which in this case flows by gravity along the public road, would entail enormous costs for storm sewers, earthworks (movimientos de tierra), expropriations, and the loss of the investment made thus far in improvements.” (…)”. (Proven Fact N° 11; see Official Letter N° MO-DPDT-IV-177-2021 dated 24 de noviembre de 2021, appearing at images 183 and 184 of the court record in electronic format, and the testimony of Messrs. Juan Pablo González Calderón and Javier Alberto Umaña Durán during the Oral and Public Trial Hearing). On this particular issue, given the nature of the easement, responsibility is shared between the owner of the property—arising from the legal obligations established in section 20 of the Ley General de Caminos Públicos to perform work to keep the drainage easement (servidumbre fluvial) clean and in perfect condition, within reasonable and proportionate bounds—and the Municipalidad de Orotina, which, in light of the situation it has identified concerning the stormwater system’s capacity problems, and as the administrator of the cantonal public roads pursuant to sections 1 and 2 of the Ley General de Caminos and of the stormwater system as a whole, must intervene to seek a prompt solution to this situation.
The Municipality’s position rests on a false premise: that when the stormwater system enters private property, it becomes private, which is not the case. To reiterate, according to the evidence in the record, there is a public road in the area at issue, and that road has a stormwater system that runs across the claimant’s land through infrastructure constituting an easement for the benefit of the road system administered by the municipality itself. In other words, as administrator of that road system, the municipality is competent to take the actions necessary to guarantee the optimal and effective operation of the public road under its responsibility, without prejudice to the claimant’s obligations under section 20 of the Ley General de Caminos Públicos. It must be recalled that, pursuant to section 169 of the Constitution, the Local Government was vested with authority to administer local interests and services in each canton, an administration that entails managing both material and human resources and is not limited—as its position would appear to suggest—to conducting an inspection and determining that it cannot exercise its authority because of the volume of resources that must be invested and because a third party designed the system.
The fact that a third party performed works, whether or not in compliance with the body of applicable law (bloque de legalidad), does not relieve the Municipality of its administrative role. Municipal activity rests on a series of political, planning, budgetary, recreational, educational, and general service-delivery functions, all aimed at promoting the comprehensive development of the persons who reside within its jurisdiction. It also possesses police powers (poderes de policía) to maintain order within its jurisdiction, together, of course, with the powers assigned to national public institutions. Constitutionally, however, the Municipality has a very important role in administering those cantonal interests. This role originates in the need to decentralize the State and to provide cantons, given their proximity to the population, with the ability to safeguard public interests and objectives for the benefit and advancement of the local community.
The Sala Constitucional de la Corte Suprema de Justicia has so held, stating that: “(…) as established by section 169 of the Constitución Política and the Código Municipal, the municipalities are responsible for administering local services and interests for the purpose of promoting the comprehensive development of the cantons in harmony with national development. Consequently, the Municipality must establish a comprehensive urban-planning policy in accordance with the applicable law, aimed at the efficient and harmonious development of urban centers and guaranteeing—at a minimum—efficient electricity and communications services; sound systems for supplying drinking water and disposing of wastewater (aguas servidas); adequate water-supply and sewer systems; city lighting and beautification systems; services for the construction, repair, and cleaning of streets and other public thoroughfares; and, in general, concrete and practical plans to make life comfortable and safe for the population.” (See Sala Constitucional de la Corte Suprema de Justicia.
Resolution Nº 12886 – 2011 at 12:44 on 23 de Setiembre del 2011). (Emphasis not in the original). It should be noted that the Constitutional Court expressly recognizes the Municipality’s authority to administer the canton’s sewer and stormwater systems, which is, of course, logical because in practice these systems are interconnected rather than isolated, and each design constructed to discharge water from any of the canton’s inhabitants, or from persons participating in its economy, affects the entire canton. Accordingly, the Court does not share the Municipal Council’s view that this is a private problem or a matter outside its authority. Quite the contrary: in addition to receiving the complaint filed by the claimant on 14 de enero de 2021, which described the problem, and processing it on 03 de febrero de 2021 (See Proven Facts N° 9 and 10), the Municipal Corporation should have established a strategy for addressing the situation.
It is not being required to do so solely with its own resources; rather, it has a duty to provide public services effectively and efficiently (section 4 of the Ley General de la Administración Pública) and, using the mechanisms provided by the legal system, to plan a solution for the “El Vivero” Settlement, but it failed to do so. It is true that it has made some improvements to the road surface and the storm sewer system (see Proven Facts N° 11 and 12), but those efforts were not shown to be effective in mitigating the effects on the claimant’s property. In its answer to the complaint, the Municipal Council’s representative states, for example, that if there is a problem involving discharges (vertidos), the claimant must resolve it; the response given when her complaint was processed followed the same line (See Proven Fact N° 10). What is notably absent, however, is any indication that, despite clearly understanding the situation, the Municipality notified the Ministerio de Salud and coordinated with it to address the matter.
Processing a complaint does not mean resolving the situation, and the Municipality has a duty to resolve it because it is responsible for coordinating and administering the canton’s stormwater systems and addressing local needs, particularly when health concerns are involved (discharges).
Therefore, the exercise of urban planning (planificación urbana), and the granting of permits (licencias)—including stormwater discharge permits (licencias de desfogue pluvial)—that form part of the aforementioned political authority over urban planning inherently entail the police power (potestad de policía) and the power to verify that economic, agricultural, commercial, urban-development, tourism, recreational, productive, educational, cultural, and other activities are conducted within the framework of legality (bloque de juridicidad) and in harmony with the environment. This follows from provision 50 of the Fundamental Law and, at the statutory level, is embodied in section 28 of the Ley Orgánica del Ambiente. This duty to administer the interests of the canton remains even when a third party, having failed to comply with the formalities and requirements, constructed or erected infrastructure within its territorial jurisdiction; accordingly, the Municipality must become involved in seeking a comprehensive solution to the situation.
It is within this constitutional framework that Article 3 of the Código Municipal must be understood, which provides that: “The governance and administration of cantonal interests and services shall be entrusted to the municipal government,” as must section 1 of the Ley de Construcciones, which states: “The Municipalities of the Republic are responsible for ensuring that cities and other population centers meet the necessary conditions of safety, sanitation, convenience, and beauty in their public roads and in the buildings and structures erected on land located therein, without prejudice to the powers granted by law in these matters to other administrative bodies.” It should be noted that the statutory provisions do not exclude the exercise of municipal powers over private property; establishing conditions for balanced urban development is part of the Municipality’s urban-regulation duties, and this also requires construction projects to be harmonious throughout the canton as a whole, in both rural and urban areas and in both the public and private spheres.
It is therefore incorrect, as the Municipality stated on several occasions, that it cannot invest resources in resolving an issue within private property, because the lack of capacity in the stormwater system affects not only the plaintiff’s property but could also worsen in the future as rainfall increases or other buildings are constructed at the site. This Court understands the various difficulties faced by Local Governments, particularly in terms of resources, as well as the considerable demands of present-day populations, which increasingly require more services from Municipalities and demand spaces for extensive citizen participation, transparency, and accountability. At the same time, however, greater urban development and the growth of populations and cities pose major challenges in balancing municipal powers with private property and freedom of commerce. Specifically in municipal matters, since the earliest days of the Sala Constitucional, it has been recognized at the constitutional level that, when exercising their authority to administer the canton’s interests directly, Municipalities may, and indeed may be required to, do so through close coordination with the various public entities, using relationships of coordination and cooperation that enable them to fulfill the constitutional and statutory objectives entrusted to them.
Thus, the Sala Constitucional de la Corte Suprema de Justicia stated: “III.- GENERAL CONCEPTS REGARDING THE MUNICIPAL SYSTEM. In Costa Rica, the municipal system is a form of territorial decentralization, as follows from the first paragraph of constitutional Article 168. It is defined primarily in Articles 169 and 170 of the Constitución Política, which state, insofar as relevant, that the ‘administration of local interests and services shall be entrusted to the Municipal Government, composed of a popularly elected deliberative body and an executive officer designated by law’ (today, the Municipal Mayor); it is a ‘corporate system that enjoys autonomy and its own financial resources (budgetary authority).’ From this statement of the principal legal features of the municipal institution, it is entirely clear that certain elements follow, namely: the existence of a territorial jurisdiction for addressing local-level interests and services; the formation of a population linked by ties of proximity, such that every inhabitant of the Canton is a municipal resident; a government composed of two distinct bodies (Council and Mayor), whose functions and relationships are defined; the institution’s corporate nature; a constitutional guarantee of independence (autonomy); and the subject matter of its administration, comprising everything that is or constitutes a ‘local interest and service.’ From a political standpoint, municipalities are representative governments with authority over a specific territory (canton), their own legal personality, and public powers with respect to their municipal residents (inhabitants of the canton); they operate in a decentralized manner in relation to the Government of the Republic and enjoy constitutionally guaranteed and reinforced autonomy, which is manifested politically in their ability to determine their own goals and the regulatory and administrative means for providing all types of public services to promote the common good in their community.
(...) All of this necessarily means that, in order to define the structure of the Costa Rican State properly, there must be an exact alignment of the Municipal Governments, both collectively and individually, with respect to their relationships and coordinated operation with the Government of the Republic, in order to prevent the simultaneous coexistence of spheres of power of differing origin and nature, the duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved.” (Sala Constitucional, Resolution Nº 05445-1999 at 14:30 hours on 14 de Julio del 1999). These coordination powers are expressly established in provision 6 of the Código Municipal, which provides that: “The municipality and the other bodies and entities of the Public Administration shall coordinate their actions. For that purpose, they shall provide due advance notice of the works they plan to carry out.” The Municipality could have availed itself of these interinstitutional coordination and cooperation mechanisms, but the record contains no evidence that it did so.
It should be noted that the Local Government’s need to coordinate with other institutions having local, regional, or national authority is expressly set forth in provision 6 of the Código Municipal, which states: “Article 6. - The municipality and the other bodies and entities of the Public Administration shall coordinate their actions. For that purpose, they shall provide due advance notice of the works they plan to carry out.” It could even have resorted to interinstitutional agreements (convenios interinstitucionales) in order to fulfill its statutory mandates, pursuant to Article 7 of the Código Municipal, which provides: “By means of an agreement with other municipalities or with the competent public entity or body, the municipality may carry out, jointly or individually, services or works within its canton or territorial region. (As amended by Article 17 of the ley General de transferencia de competencias del Poder Ejecutivo a las Municipalidades, N° 8801 of 28 de abril de 2010).” These coordination and cooperation mechanisms have been recognized by the Sala Constitucional, which found them consistent with the constitutional framework (bloque constitucional), stating that: “X.- THE DUTY OF COORDINATION WITH STATE INSTITUTIONS.
Several of the provisions challenged in this constitutional action—Articles 5, 10, and 186 of the Código Municipal; 2 of the Ley de Tránsito por Vías Públicas Terrestres; 2 of the Ley General de Caminos Públicos; 9 and 10 of the Ley de Planificación Nacional; 26 and 27 of the Ley General de la Administración Pública; and 4, 10, 16, 17, and 18 of the Ley de Planificación Urbana—refer to the duty of coordination that must exist among local governments, decentralized institutions, and the Executive Branch in carrying out the functions entrusted to them, which must be analyzed on the basis of the very nature of municipal autonomy. By virtue of constitutional Article 170, municipalities (local corporate entities) enjoy functional, administrative, and financial autonomy in administering local interests and services (Article 169 of the Constitución Política), as has been repeatedly recognized in constitutional case law (in this regard, see, among others, judgments number 01119-90, 02934-93, 00140-94, 03494-94, 06000-94, 03930-95, 02231-96, and 06469-97.
(…) Once the municipality’s substantive jurisdiction (competencia material) within a particular territorial district has been defined, it is clear that some responsibilities are, by their nature, exclusively municipal, alongside others that may be regarded as national or state responsibilities. It is therefore essential to define the form of shared exercise of powers (coparticipación de atribuciones) that is inevitably required, since the municipalities’ public authority is local, whereas that of the State and other entities is national; consequently, municipal territory is simultaneously state and institutional territory to the extent required by the circumstances. In other words, municipalities may share their powers with the Public Administration in general, and that relationship must operate under the terms defined by law (Article 5 of the former Código Municipal and Article 7 of the new Código), which establishes a duty of ‘coordination’ between municipalities and the public institutions jointly exercising their respective powers, in order to prevent duplication of efforts and contradictions, particularly because only voluntary coordination is compatible with municipal autonomy, as an expression thereof.
In other words, the municipality is called upon to establish cooperative relationships with other public entities, and vice versa, given the concurrent or overlapping nature—in many cases—of their interests concerning a specific matter. In legal scholarship, coordination is defined on the basis of the existence of several independent centers of action, each with its own responsibilities and decision-making powers, which may potentially conflict; nevertheless, there must be a commonality of purposes by subject matter, arising from concurrence, insofar as the object receiving the final results of each one’s activities and acts is common to them. Coordination is thus the ordering of relationships among these various independent activities, taking into account their concurrence upon the same object or entity so as to make it useful to an overall public plan, without eliminating the reciprocal independence of the acting entities.
Because no hierarchical relationship exists among decentralized institutions, or between the State itself and the municipalities, particular conduct cannot be imposed upon the latter. This gives rise to the indispensable interinstitutional ‘concerted action’ (concierto), in the strict sense, whereby the autonomous and independent centers of action agree upon that preventive and overall framework, within which each performs a role with a view to a mission entrusted to the others.” (Emphasis added by the author). (Sala Constitucional, Resolution Nº 05445 – 1999 at 14:30 hours on 14 de Julio del 1999, cited).
Thus, the Municipality is also required to resort to various public works planning mechanisms. Those constitutional and statutory powers also include the establishment of municipal policy by the Municipal Council, setting the canton’s priorities to promote what has been stated above: the canton’s comprehensive and forward-looking development. Accordingly, Article 13 of the aforementioned Municipal Code provides that the municipal collegiate body is responsible for: “a) Establishing the municipality’s development policy and priorities, in accordance with the government program submitted by the municipal mayor for the term for which he or she was elected and through the participation of local residents”; (…) “d) Organizing, by regulation, the provision of municipal services”; and “l) Approving the Municipal Development Plan and Annual Operating Plan prepared by the person holding the office of mayor, based on his or her government program and incorporating the population’s diverse needs and interests in order to promote gender equality and equity,” among other powers.
It follows that the Municipal Government has broad authority to define the policy, regulatory provisions, and guidelines governing the administration of stormwater systems (sistemas pluviales), which naturally includes the planning and oversight of urban development (ordenamiento urbano), while seeking a balance between satisfying the public interest and meeting the needs of the area’s inhabitants. This is pursuant to Article 113 of the General Law of Public Administration (Ley General de la Administración Pública), which provides: “1. Public servants shall perform their duties in a manner that primarily satisfies the public interest, which shall be understood as the expression of the coinciding individual interests of those subject to the administration. 2. The public interest shall prevail over the interest of the Public Administration whenever the two may conflict. 3. In assessing the public interest, primary consideration shall be given to the values of legal certainty and justice for the community and the individual, which may under no circumstances be subordinated to mere convenience.” For this Court, satisfying the public interest includes the efficient and effective management of the stormwater systems within the Municipality’s territorial jurisdiction, seeking a comprehensive solution to the situation occurring in Asentamiento "El Vivero", and undertaking, jointly with other entities and without diminishing the plaintiff’s obligations, the works required for its prompt resolution.
In this regard, it must be clarified that this Court’s statements cannot be construed to mean that Ms. Venegas Montero is not required to fulfill her legal obligations to maintain the stormwater outlet (desfogue pluvial) located on her property and remove any debris and garbage obstructing the culvert (alcantarilla). That is not the position of this Judicial Body. Rather, the Municipality itself has identified a problem that must be addressed concerning the capacity of the stormwater system, among other issues that may eventually need to be diagnosed. It must therefore carry out work aimed at mitigating the effects of actions previously undertaken without municipal authorization or participation, coordinating with the corresponding public entities to seek investment in that area and, through forward-looking planning, remedy the defects or conditions currently affecting the stormwater system of Asentamiento "El Vivero".
All of this must respect the technical discretion and municipal autonomy vested in the Municipal Corporation, remain within its constitutionally established powers to administer local matters, and involve coordination with any public and private entities it deems appropriate. From this perspective, the plaintiff’s claim that a solution be sought and implemented for the stormwater problem in Asentamiento "El Vivero" and its effects on her property is partially granted. Such actions must be carried out reasonably and proportionately, in accordance with science and technology, and following prior coordination with the corresponding public entities. -
As explained above, and not repeated here to avoid redundancy, based on the failure to expropriate the strip where the easement (servidumbre) is located, she requests compensation, as well as compensation for “damage to the remainder” (daño del remanente). Regarding this matter, the arguments made by both parties, as transcribed in the first recitals (considerandos) of this Decision (third and fourth), apply, as does what was already discussed in the recital entitled “Specific Case.” OPINION OF THE COURT. As stated in the preceding recital, Article 41 of the Political Constitution, in conjunction with constitutional Articles 9, 11, and 33, establishes a predominantly strict-liability regime (régimen de responsabilidad objetiva) for the State, which is based on the existence of three elements: the occurrence of damage (for which compensation may be awarded, that is, damage causing pecuniary or non-pecuniary injury to the person), conduct (by omission or commission) on the part of the Administration (in this case, the Municipalidad de Orotina), and a causal link (nexo causal) between the two.
That causal link would be broken by the existence of a defense excluding liability (eximente de responsabilidad), such as “force majeure, fault of the victim, or the act of a third party,” pursuant to Article 190, subsection 1), of the General Law of Public Administration. In this regard, as noted above, the plaintiff seeks payment for damage to the remaining parcel of more than 679 m2 and for the imposition of an easement; nevertheless, based on the analysis of the principal claims underpinning the plaintiff’s theory of the case, no omission by the Municipalidad de Orotina was established, nor was any claim asserted seeking a declaration of the strict liability of that Local Government for other damages or conduct. Instead, as noted, it depended on granting the request that an expropriation proceeding (procedimiento de expropiación) be carried out, a claim that was denied. In view of the foregoing, because an adequate causal connection between the conduct of the defendant Local Government and the damages claimed by the plaintiff was not established, her claims for payment or compensation cannot therefore be granted.
In this regard, the First Chamber of the Supreme Court of Justice, in Decision N° 112-1992 at 14:15 hours on 15 de julio de 1992 (a position that has been consistently reiterated to date and that is shared by this Panel of Judges), stated: “Damage constitutes one of the prerequisites for non-contractual civil liability (responsabilidad civil extracontractual), because the duty to provide compensation arises only when there has been an unlawful and harmful act that injures a legally relevant interest capable of protection under the legal system. Damage, in the legal sense, constitutes any impairment, loss, or detriment to a person’s pecuniary or non-pecuniary legal sphere (the injured party), resulting in the deprivation of a legal interest whose preservation could objectively have been expected had the harmful event not occurred. Under this approach, there is no civil liability absent damage, just as there is no damage absent an injured party.
Moreover, only damage that is proven (its reality or existence) is compensable, this being a question of fact entrusted to the prudent discretion of the adjudicator. In short, damage constitutes the detrimental gap suffered by the victim, resulting from comparing the situation before the unlawful act with the situation after it. (...)” (Emphasis added by this Court). It follows that, absent liability attributable to the Municipalidad de Orotina, no right to compensation can arise. And, as may properly be inferred from the cited judicial decision and from the case law discussed throughout this analysis, if adequate causation is not demonstrated, no right can arise to obtain recognition of the alleged damages, insofar as, it bears repeating, she also failed to establish the existence of the alleged “damage to the remainder,” a necessary prerequisite for her compensation claim to succeed. This requires rejection of the claims for payment of damages and, consequently, also the ancillary claims (pretensiones accesorias) for payment of interest and indexation on the amounts that would have been awarded in the judgment, which depend upon the existence of compensation and, because that basis or foundation is denied, share the same fate as the principal claim (rejection).
Accordingly, with respect to the claims for compensation, the defense of absence of a legal right (falta de derecho) raised by the representative of the Municipalidad de Orotina in its answer is sustained, and the action filed is dismissed as to the claims contained in paragraphs 2 and 3 concerning payment for the strip where the easement is located, damage to the remainder, and interest and indexation on those amounts. -
In its answer to the complaint, the representative of the Municipalidad de Orotina raised the defenses (excepciones) of lack of standing as defendant (falta de legitimación pasiva) and absence of a legal right. Accordingly, given the manner in which this matter has been decided, in that, after analyzing the record and the evidence offered by the parties and admitted at the proper procedural stage, this Collegiate Panel partially grants the claims solely insofar as it determines the existence of an easement on the plaintiff’s property—an easement classified as statutory (Article 20 of the General Law of Public Roads)—and grants the affirmative relief (conducta de hacer) requested by the claimant, namely, that the Municipalidad de Orotina be ordered to remedy the stormwater discharge problem, the action filed by Ms. [Nombre 002] is consequently partially granted on the basis of the factual and legal arguments set forth in this Decision.
Therefore, the defense of lack of standing as defendant is partially sustained because it was not established that the Municipalidad was the legal entity that installed or constructed the easement affecting property recorded under real-property folio N° 322557-000 of the Alajuela Registry District, owned by the plaintiff. The defense of absence of a legal right is also partially sustained with respect to the request for a declaration that the Municipal Corporation constructed and installed the easement; the Local Government’s alleged omission in carrying out the expropriation proceeding for the affected land and, consequently, in making the corresponding payment for the strip of land where the aforementioned easement is installed; and the alleged damage to the remainder, together with the resulting interest and indexation claimed on any amounts that might have been determined, based on the foregoing findings in the judgment at issue. -
With respect to the costs of these proceedings, pursuant to Article 193 of the Administrative Litigation Procedure Code, procedural costs and attorney’s fees constitute a burden imposed upon the losing party by reason of having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is entered on the basis of evidence whose existence was unknown to the opposing party. In this case, this Panel finds that, because the parties have each prevailed in part on the matters disputed in this litigation, both the plaintiff and the defendant had sufficient grounds to litigate; accordingly, this judgment must be entered without a specific award of costs. -
POR TANTO
Based on the factual and legal grounds set forth above, the defenses of lack of standing as defendant and absence of a legal right raised by the defendant Municipalidad are partially sustained and, consequently, the action filed by Ms. [Nombre 002] against the MUNICIPALIDAD DE OROTINA IS PARTIALLY GRANTED, with all relief not expressly granted deemed denied. The MUNICIPALIDAD DE OROTINA is ordered to implement, carry out, coordinate, and/or require the appropriate party to undertake specific actions to identify and remedy the problems occurring in the stormwater system (sistema de aguas pluviales) of the Asentamiento “El Vivero,” so as to definitively resolve the problems affecting the plaintiff’s property. Pursuant to Article 157 of the Administrative Litigation Procedure Code, those actions must be performed within a period not exceeding three (3) months, counted from the day following notification of this judgment, it being understood that the enforcement judge (juez de ejecución) shall approve and oversee the actions necessary for effective compliance with this judgment.
The matter is decided without a specific award of costs because both parties prevailed in part. MUNICIPALIDAD DE OROTINA N° 2024003114 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las quince horas con catorce minutos del trece de Mayo del dos mil veinticuatro.- Proceso de Conocimiento interpuesto por la señora [Nombre 002], [...], contra la MUNICIPALIDAD DE OROTINA, representada por el señor Randall Marín Orozco, con cédula de identidad N° 2-0452-0092 y carné del Colegio de Abogados y Abogadas de Costa Rica Nº 5586, en calidad de apoderado judicial especial. Participa como apoderado judicial del proceso de la parte actora, el señor Joan Castillo Umaña, carné del Colegio de Abogados y Abogadas de Costa Rica Nº 8583.
ACTUACIONES PROCESALES. Como parte del íter procesal se tiene lo siguiente:
Mediante escrito de demanda presentado en fecha 17 de junio del 2021, la parte actora formuló las siguientes pretensiones, a fin de que en sentencia se declare lo siguiente: “-Que mediante sentencia se declare que la finca de mi propiedad e inscrita en el Registro Nacional, Sección Inmueble, Provincia de Alajuela, Folio Real número 322557-000 se encuentra afectada por una servidumbre de conducción de aguas por parte de la Municipalidad de Orotina, sin que ésta haya pagado suma alguna por concepto de expropiación. - Que se declare que la Municipalidad de Orotina no cumplió con el debido proceso administrativo de expropiación e indemnización a favor del propietario de la finca del Partido de Alajuela, Folio Real número 322557-000, por la introducción de una servidumbre de aguas en la citada finca. - Solicito se condene a la demandada al pago del área de terreno que conforma la servidumbre, a pagar el daño al remanente de la propiedad, al pago de la indexación que tengo derecho y a pagar los intereses de ley, mismos que se deben de calcular a partir de la toma de posesión del terreno, sea desde el 15 de enero del año 2004 hasta la fecha del efectivo pago del monto establecido; intereses que se calcularán sobre el monto de la indemnización y de acuerdo a la tasa de interés de los certificados de depósito a plazo a 6 meses del Banco Nacional de Costa Rica. - Solicito se le ordene a la Municipalidad de Orotina a reparar la servidumbre de aguas introducida en mi propiedad, darle continuidad a la canalización de la misma para que las aguas que en ella transitan sean sacadas de mi predio por el lindero norte de mi propiedad hasta darle una correcta y efectiva conducción a las aguas hasta un lugar seguro. - Solicito se condene a la demandada al pago de las costas personales y procesales de la presente acción”.
Dichas pretensiones se mantuvieron incólumes en la Audiencia Preliminar llevada a cabo en fecha 06 de julio de 2012. (Ver imágenes 2 a 11, del expediente judicial en formato electrónico, y Minuta de Audiencia Preliminar, visible a imágenes 231 a 235 del expediente judicial en formato electrónico, así como audio de la Audiencia Preliminar en el Sistema SIGAO).
Mediante la resolución de las 9:40 horas de fecha 24 de agosto de 2021, el Tribunal Contencioso Administrativo y Civil de Hacienda previno a la parte actora, a fin de que ajustara los hechos del escrito de su demanda, de conformidad con los numerales 58 y 61 del Código Procesal Contencioso Administrativo (en adelante CPCA). (Ver imágenes 26 y 27 del expediente judicial en formato electrónico).
Mediante memorial de fecha 03 de setiembre de 2021, el representante legal de la actora atendió la prevención efectuada mediante la resolución de las 9:40 horas de fecha 24 de agosto de 2021, del Tribunal Contencioso Administrativo y Civil de Hacienda realizando un ajuste concretamente en los hechos de la demanda, pero manteniendo invariables el elenco de pretensiones, y el ofrecimiento de la prueba establecidos en su demanda. (Ver imágenes 29 a 31 del expediente judicial en formato electrónico).
Conferido, mediante la resolución de las 10:00 horas del 12 de octubre de 2021 por parte del Tribunal Contencioso Administrativo y Civil de Hacienda, el traslado de la demanda a la Municipalidad de Orotina; en fecha 02 de diciembre de 2021, contestó de forma negativa la demanda, interponiendo en ese acto las defensas de falta de legitimación pasiva y falta de derecho. A partir de lo cual, solicitó que se declare sin lugar la demanda en todos sus extremos, y se condene a la parte actora al pago de ambas costas. (Ver imágenes 33 a 35, y 40 a 54 del expediente judicial en formato electrónico).
Mediante resolución de las 11:03 horas del 04 de marzo de 2022, el Tribunal Contencioso Administrativo y Civil de Hacienda confiere audiencia a la parte actora para referirse a las excepciones de falta de legitimación activa y falta de derecho interpuestas por la Corporación Municipal en su contestación de la demanda, por un plazo de tres (3) días hábiles. A la fecha del dictado de la presente sentencia, no consta pronunciamiento alguno por parte de la señora [Nombre 002] respecto a la audiencia referida. (Ver imágenes 215 y 216 del expediente judicial en formato electrónico).
La audiencia preliminar se celebró el día 06 de julio del 2022, con la presencia de la parte actora, y de la representación de la Municipalidad demandada. En ésta, las partes manifestaron que no encontraron vicios dentro del procedimiento; se mantuvieron las pretensiones conforme a lo establecido en el libelo de la demanda; se determinaron como hechos controvertidos todos los hechos menos el correspondiente al tercero, y se admitió la prueba documental aportada por ambas partes. En cuanto a la prueba testimonial se admitió por parte de la actora, al señor Luis Fernando Araya Arguedas, con cédula de identidad N° 1-0736-0171, y en cuanto al ofrecimiento de la prueba testimonial de la Municipalidad de Orotina, se admitió a los señores Juan Paulo González Calderón, con cédula de identidad N° 1-1348-0230; Javier Umaña Durán, con cédula de identidad N° 1-954-0885 y José Pablo Rojas González, con cédula de identidad N° 1-1274-0333. Aunado a lo anterior, se admitió la designación de un Ingeniero Topógrafo en condición de perito judicial. Ordenándose a ser trasladado el presente proceso a la Sección de Juicio que por turna corresponda. (Ver Audio y Minuta de la Audiencia Preliminar, visible a imágenes 231 a 235 del expediente judicial en formato electrónico).
En fecha 10 de octubre de 2022, el señor Luis Jonathan González Portuguez, Ingeniero Topógrafo con Registro N° IT-21339 y con cédula de identidad N° 1-0959-0759 rindió el informe pericial respectivo. (Ver 265 a 267 del expediente judicial en formato electrónico).
En fecha 13 de octubre de 2022, el representante de la parte actora solicitó el nombramiento de un perito evaluador, solicitud que fue rechazada mediante la resolución de las 15:04 horas de fecha 31 de octubre de 2022 emitida por el Tribunal Contencioso Administrativo y Civil de Hacienda. (Ver imágenes 277 y 278 del expediente judicial en formato electrónico).
Mediante la resolución de las 15:04 horas de fecha 31 de octubre de 2022 emitida por el Tribunal Contencioso Administrativo y Civil de Hacienda confirió audiencia, por el término de tres (3) días hábiles a las partes, para que se refirieran al informe pericial rendido en fecha 10 de octubre de 2022. En fechas 02 y 07 de noviembre de 2022, la accionante y la demandada, respectivamente; solicitaron la adición y aclaración del Informe Pericial mencionado. (Ver imágenes 278 a 285 del expediente judicial en formato electrónico).
Mediante resolución de las 13:28 horas de fecha 15 de noviembre de 2022, el Tribunal Contencioso Administrativo y Civil de Hacienda otorgó un plazo de tres (3) días hábiles, a fin de que el señor González Portuguez se refiriera a las solicitudes de adición y aclaración del Informe Pericial rendido. (Ver imagen 288 del expediente judicial en formato electrónico).
En fecha 06 de diciembre de 2022, el señor González Portuguez se pronunció sobre las solicitudes de adición y aclaración del Informe Pericial requeridas por ambas partes. (Ver imágenes 335 a 347 del expediente judicial en formato electrónico).
Mediante la resolución de las 13:32 horas del 09 de enero de 2023, el Tribunal Contencioso Administrativo y Civil de Hacienda confirió audiencia a las partes para que se pronunciaran sobre los extremos manifestados por el señor González Portuguez en relación con la prueba pericial rendida. (Ver imagen 348 del expediente judicial en formato electrónico).
En fecha la Municipalidad de Orotina, reiteró su solicitud de adicionar el Informe Pericial efectuada por el señor González Portuguez. (Ver imágenes 349 y 350 del expediente judicial en formato electrónico).
Mediante resolución de las 10:10 horas de fecha 27 de febrero de 2028, la Jueza de Trámite fijó la fecha para la celebración del juicio oral y público, turnándose el expediente judicial de marras, en fecha 18 de enero de 2023, para ser conocido por la presente Sección Primera del Tribunal Contencioso Administrativo y Civil de Hacienda. (Ver imágenes 354 a 359 del expediente judicial en formato electrónico).
El juicio oral y público fue celebrado a las 8:30 horas del día 29 de abril de 2024, con la presencia de ambas partes del proceso. En ésta, las partes indicaron no contar con ningún aspecto de saneamiento del proceso, y la parte actora solicitó que se admitiera como prueba para mejor resolver una resolución judicial emitida por parte del Tribunal Contencioso Administrativo y Civil de Hacienda, la cual no fue admitida por esta Cámara de Juzgadores, al no constituir prueba en sentido técnico, tomando nota de dicha resolución para los efectos correspondientes. Las partes emitieron sus alegatos de apertura, y se recibió la prueba pericial admitida por parte del señor Luis Jonathan González Portuguez. Adicionalmente se recibieron las deposiciones de los señores Luis Fernando Araya Arguedas, cédula de identidad 1-0736-0171; Juan Paulo González Calderón, con cédula de identidad N° 1-1348-0230; Javier Umaña Durán, con cédula de identidad N° 1-954-0885 y José Pablo Rojas González, con cédula de identidad N° 1-1274-0333, y se concedió el espacio para que tanto la parte actora como la representación de la Municipalidad rindieran conclusiones.
Tomando en consideración el acervo probatorio y las pretensiones deducidas en demanda, a la luz del numeral 111 inciso 1) del Código Procesal Contencioso Administrativo y 47 del Reglamento Autónomo de Organización y Servicio de la Jurisdicción Contencioso Administrativa y Civil de Hacienda, se declaró el proceso de tramitación Muy Compleja, procediéndose a diferir el dictado de la sentencia, por el plazo de quince (15) días hábiles. (Ver Minuta del Juicio Oral y Público y soporte de Audio y Video en SIGAO).
En los procedimientos se han observado las prescripciones y términos de ley, y no se perciben vicios, defectos u omisiones susceptibles de producir nulidad de lo actuado o indefensión a las partes. Se dicta la presente resolución por unanimidad y previa deliberación de los miembros del presente Tribunal, respetando los criterios de priorización para la atención de los procesos, conforme al rediseño del Tribunal Contencioso Administrativo y Civil de Hacienda, y dentro del plazo conferido por el precepto 111.1 del Código Procesal Contencioso Administrativo.
Redacta la jueza Morales Herra, con el voto afirmativo de los jueces Bolaños Salazar y Mejías Rodríguez.
CONSIDERANDO
HECHOS PROBADOS: Conforme al elenco documental probatorio admitido en este proceso y la prueba pericial y testimonial evacuada en la celebración del Juicio Oral y Público, se tienen como demostrados y de relevancia para el dictado de la presente sentencia, por tener el correspondiente sustento, los siguientes hechos:
Lo anterior, con sustento, entre otros motivos: “(…) 18. Que el Instituto de Desarrollo Agrario en Orotina ha desarrollado proyectos habitacionales o fraccionamientos sin llevar a cabo ninguna coordinación con la Municipalidad, tales son Cebadilla, Santa Rica, Cerro Bajo, Cerro Alto, Mollejones, Vivero, Huacas, Cámara, Los Mangos, Cuatro Esquinas. 19. Que los proyectos anteriores fueron denominados granjas familiares, correspondiendo a fragmentaciones agrícolamente irracionales, encubriendo desarrollos urbanísticos para no cumplir con las disposiciones de ley, ya que los fraccionamientos corresponden a áreas entre 1000 y 2000 metros cuadrados, creando minifundios que no corresponden a la función sustantiva del IDA. (…) 21. Que no existe en el Instituto Nacional de Vivienda y Urbanismo ningún anteproyecto de Vivienda rural o antecedente de coordinación presentado por el IDA para su aprobación en el cantón de Orotina, cuando la Ley de Tierras lo obliga a coordinar su labor con ese ente.
Su desarrollo debe ser debidamente planificado para lograr la infraestructura básica en coordinación con otros entes del estado, y así lograr un ambiente armonioso y dignificante para la familia, situación que al día de hoy 10 años después de las entregas de dichas granjas existen fraccionamientos sin los servicios exigidos por la ley para una vida digna.(…) Que en las últimas dos administraciones y en lo que ha transcurrido de la actual, el Director Regional del IDA, nunca se ha presentado ante este Consejo a llevar a cabo coordinación alguna con respecto a la materia de incumplimiento, como la falta de servicios básicos, y muchos menos proponer un plan de acción para normalizar la situación de los mal llamados programas de granjas familiares de parte del IDA…” (Transcripción del Acuerdo VI, Inciso 1, Aparte 2 de la sesión ordinaria N° 60 celebrada el día 02 de enero de 2007, visible a imágenes 187 a 193 del expediente judicial en formato electrónico).
(…) en la inspección realizada se logra apreciar que el desfogue de aguas que pasa por esta propiedad no es posible modificarlo, ya que se encuentra en el punto más bajo de la calle y es el punto de desagüe creado por el desarrollador de la urbanización, por lo que el desviar el recorrido actual de las aguas pluviales, que en este caso por gravedad, por la vía pública; vendría en representar costos enormes de alcantarillados pluviales, movimientos de tierra, expropiaciones y pérdida de la inversión realizada hasta el momento para el mejoramiento, (…)”. (Ver Oficio N° MO-DPDT-IV-177-2021 de fecha 24 de noviembre de 2021, visible a imágenes 183 y 184 del expediente judicial en formato electrónico y testimonios de los señores Juan Pablo González Calderón y Javier Alberto Umaña Durán, durante la Audiencia del Juicio Oral y Público).
En ese informe se tomaban consideraciones como la falta de Área Pública, Facilidades Comunales, Parques e Infraestructura Vial y del Centro Poblacional de El Vivero en Coyolar de Orotina, sitio en el cual se encuentra la finca con matrícula N° 2-322557-000 originalmente a nombre del Instituto de Desarrollo Rural (INDER) no ha sido entregado formalmente a la Municipalidad de Orotina estas Facilidades Comunales y/o Urbanísticas (…). Adicionalmente se realizar (sic) un levantamiento de las curvas de nivel en el sector, sobre el derecho de vía, esto para corroborar los niveles y según el análisis realizado de la interpretación de dichas curvas, topográficamente, frente a la propiedad en cuestión se encuentra el punto con los niveles más bajos. (…)”. (Ver Oficio N° MO-A-DPDT-GT-100-2021 de fecha 30 de noviembre de 2021, visible a imágenes 178 y 179 del expediente judicial en formato electrónico).
Se tiene como hechos nos probados de relevancia para el dictado de la sentencia, sea porque las partes incumplieron con sus cargas probatorias, o bien, porque este Tribunal no halló prueba idónea que, a la luz del principio de la sana crítica, permitiera acreditarlo, el siguiente:
En su escrito de demanda y en la fase de conclusiones efectuada en la audiencia de Juicio Oral y Público, la actora, [Nombre 002], refiere a que, es propietaria del inmueble ubicado en Coyolar de Orotina de la Provincia de Alajuela, inscrita bajo la matrícula folio real N° 322557-000, Lote 27 del Asentamiento "El Vivero". Reprocha que sin su consentimiento (por no encontrar viviendo en dicha propiedad) el 15 de enero de 2004 la Municipalidad de Orotina construyó e instaló una servidumbre de aguas pluviales y servidas en su propiedad, la cual atraviesa desde el frente hasta el fondo, en dirección sur hacia el norte, con una longitud de aproximadamente cincuenta metros lineales y con un ancho de dos metros, servidumbre que continua a la propiedad colindante hacia el norte, y que se mantiene en funcionamiento desde hace 17 años, con efectos continuados sobre su esfera patrimonial. Recrimina que, la Corporación Municipal demandada no cumplió con el proceso expropiatorio previo establecimiento de la servidumbre pluvial en su inmueble, trasgrediendo con ello el numeral 45 de la Constitución Política, artículo 13 de la Ley de Expropiaciones y los artículos 190 y 191 de la Ley General de la Administración Pública.
Así como lo dispuesto por la Sala Constitucional de la Corte Suprema de Justicia, en la Resolución N° 91-00796 de las 15:10 horas de fecha 26 de abril de 1991, en cuanto impone el deber indemnizatorio, tanto de la franja que ha sido dispuesta para ser destinada al bien general, como del remanente. Dado lo anterior, tampoco le ha sido indemnizado el valor del terrero donde se encuentra la servidumbre pluvial ni los daños del remanente. Afirma que, la servidumbre en su propiedad no ha sido inscrita en el Registro Nacional, por lo que carece de publicidad registral correspondiente. Continua manifestando en los hechos del libelo de la demanda interpuesta posteriormente ajustada que, "(...) esta servidumbre de hecho a afectado el valor de la propiedad, por cuanto el daño provocado al remanente es muy importante, ya que la dirección que lleva la servidumbre afecta a la propiedad de un extremo a otro afectándola en un todo, además no terminaron el trazado de la servidumbre dentro de la propiedad vecina, dejaron la misma en abandono y desde hace tres años la alcantarilla que introdujeron se quebró dentro de mi propiedad, esto provocó que mi propiedad reciba directamente los embates directos de las aguas llovidas y servidas porque todas las aguas que provienen del desagüe de la calle, son canalizadas de forma subterránea dentro de mi propiedad provocando que se reciban dichos líquidos en propiedad afectándola”.
Esgrime que el agua se estanca en su propiedad, produciendo criaderos de zancudos que, pone en peligro la salud de las personas que habitan en dicha propiedad (su persona y nietos que son menores de edad). Ante esta situación, en fecha 15 de enero de 2021, presentó formal denuncia ante la Municipalidad de Orotina, la cual únicamente fue respondida mediante el oficio N° MO-A-DPDT-003-2021 de fecha 03 de febrero de 2021, indicándole que se apersonarían a su propiedad, no obstante, no han resuelto el problema denunciado. De ahí que, fundamenta su demanda en la existencia de una responsabilidad civil de donde surge "la obligación de reparar todo aquel daño o perjuicio patrimonial o moral, que en el ejercicio de sus funciones produzca" la Corporación Municipal demandada, trascribiendo de seguido los numerales 190 y 191 de la Ley General de la Administración Pública y la Resolución N° 213-2008 de la Sala Primera de la Corte Suprema de Justicia respecto al régimen preeminentemente objetivo de la responsabilidad por el funcionamiento legítimo o ilegítimo, normal o anormal de la Administración.
Como consecuencia de dicha exposición del marco jurídico señala que "(...) en el presente caso resulta evidente que la demandada, en su carácter de institución pública, con el fin de dotar de salida a un problema de disposición de aguas, decide realizar la construcción de la servidumbre de marras; en virtud de la cual se encuentra en la obligación de procurarse el terreno suficiente para su construcción y utilización, porque mantenimiento no le da, lo cual implica la imposición de una serie de restricciones para construir, acumular materiales, sembrar árboles u obstaculizar la franja de terreno que comprende; situación que constituye una importante limitación a los atributos esenciales de mi propiedad por cuanto me impide el libre uso y disposición de mi predio”. En virtud de lo anterior, esgrime las siguientes pretensiones: “-Que mediante sentencia se declare que la finca de mi propiedad e inscrita en el Registro Nacional, Sección Inmueble, Provincia de Alajuela, Folio Real número 322557-000 se encuentra afectada por una servidumbre de conducción de aguas por parte de la Municipalidad de Orotina, sin que ésta haya pagado suma alguna por concepto de expropiación. - Que se declare que la Municipalidad de Orotina no cumplió con el debido proceso administrativo de expropiación e indemnización a favor del propietario de la finca del Partido de Alajuela, Folio Real número 322557-000, por la introducción de una servidumbre de aguas en la citada finca. - Solicito se condene a la demandada al pago del área de terreno que conforma la servidumbre, a pagar el daño al remanente de la propiedad, al pago de la indexación que tengo derecho y a pagar los intereses de ley, mismos que se deben de calcular a partir de la toma de posesión del terreno, sea desde el 15 de enero del año 2004 hasta la fecha del efectivo pago del monto establecido; intereses que se calcularán sobre el monto de la indemnización y de acuerdo a la tasa de interés de los certificados de depósito a plazo a 6 meses del Banco Nacional de Costa Rica. - Solicito se le ordene a la Municipalidad de Orotina a reparar la servidumbre de aguas introducida en mi propiedad, darle continuidad a la canalización de la misma para que las aguas que en ella transitan sean sacadas de mi predio por el lindero norte de mi propiedad hasta darle una correcta y efectiva conducción a las aguas hasta un lugar seguro. - Solicito se condene a la demandada al pago de las costas personales y procesales de la presente acción”.
Por último, fundamenta su demanda en los artículos 41 y 45 de la Constitución Política, numerales 1045 y 1048 del Código Civil, artículos 190 y siguientes y concordantes de la Ley General de la Administración Pública, Ley de Expropiaciones, Código Procesal Civil, Ley N° 6313 del Código Procesal Contencioso Administrativo, y la jurisprudencia de la Sala Primera de la Corte Suprema de Justicia, Voto N° 966-F-2005 de las 14:10 horas del 15 de diciembre de 2005.-
Señala en la contestación y en alegato de conclusiones durante la celebración de la audiencia del Juicio Oral y Público que, debe rechazarse en todos sus extremos la demanda incoada por la señora Venega Montoya, por los siguientes motivos. Apunta en primer lugar que, se tiene por acreditado que, el inmueble titular de la actora fue adquirido por ésta en marzo de 1997 directamente del Instituto de Desarrollo Agrario (actualmente el Instituto de Desarrollo Rural), el cual forma parte del Proyecto de fraccionamiento desarrollado por parte de la referida institución pública, denominado “Asentamiento El Vivero”, el cual está integrado originalmente por 93 lotes, y actualmente lo constituyen 122 lotes. Además, apunta que la actora fue beneficiaria en el mes de noviembre de 1997 del bono de vivienda para la construcción de su casa de habitación. En su criterio, al quedar acreditado que el IDA era el desarrollador del Asentamiento El Vivero, le competía a éste dotar las condiciones urbanas requeridas por los nuevos propietarios, refiriéndose a los servicios básicos tales como “la constitución de acceso adecuados (calles públicas), la disposición adecuada de las aguas pluviales (desfogue) y la dotación de áreas de uso público (parques y facilidades comunales), conforme con lo dispuesto en la Ley de Planificación Urbana y el Reglamento para el Control Nacional de Fraccionamiento y Urbanizaciones entonces vigente”.
Alude a que, no obstante, esa obligación legal, El Vivero no contó en ninguna de sus etapas con la aprobación por parte de la Municipalidad de Orotina: “no emitió la autorización o aprobación alguna del proyecto, planos constructivos, creación de calles, recepción de obras u otras actividades propias de los desarrolladores”. Rechaza que haya sido la Corporación Municipal demandada la que construyó o instaló la servidumbre de aguas pluviales y servidas dentro de la propiedad de la accionante, sino que más bien, fue el IDA quien desarrolló dicho Asentamiento, en cumplimiento de las funciones contempladas en la Ley de Creación del Instituto de Desarrollo Agrario, Ley N° 6735 del 29 de marzo de 1982 y la Ley de Tierras y Colonización, Ley N° 2825 del 14 de octubre de 1991, y por ende, esta entidad pública es la competente para la provisión de los servicios básicos en los proyectos de fraccionamiento.
No contando con autorización legal alguna para invadir una propiedad y construir dentro de una propiedad privada o invertir fondos públicos en ésta. Sostiene que, a partir del año 2014, conforme al oficio MO-DPDT-IV-177-2021 del 24 de noviembre de 2021, el Gobierno Local ha efectuado algunas inversiones exclusivamente en calles públicas del Asentamiento "El Vivero", pero partiendo de las condiciones preexistentes, entre las que se encuentran el desfogue pluvial que se encuentra ubicado en la propiedad de la señora [Nombre 002]. Dicha intervención considera que es diferente al desarrollo primigenio del Asentamiento El Vivero, y a la propia construcción del desfogue del inmueble de la propiedad de la actora, y el hecho que haya participado directa o indirectamente de inversiones complementarias, no le confiere la competencia para realizar obras a lo interno de la propiedad de un tercero, las cuales reitera que no son obra de su representada, y que incluso todo el Asentamiento El Vivero, así como otros asentamientos que fueron desarrollados por el IDA en ese momento, no fueron coordinados ni cumplieron con los procesos de aprobación de licencia municipal.
Continúa manifestando que, “de las fuentes informativas disponibles y del levantamiento topográfico efectuado por la Municipalidad de Orotina se obtiene que las condiciones orográficas y topográficas atinentes a la ubicación física del inmueble de la demandante arrojan la existencia de un declive natural que orienta el desagüe de las aguas pluviales a través de dicha propiedad”, por lo que conforme al artículo 94 de la Ley de Aguas y el numeral 20 de la Ley General de Caminos Públicos le corresponde soportar dicha limitación, sin que se requiera de expropiar su propiedad, así como “si se estuviere generando atascamiento, mala canalización o inundaciones procede un análisis del problema a efectos de que las partes involucradas, en especial los propietarios afectados, con el apoyo de la Municipalidad de Orotina y otras instituciones competentes, puedan diagnosticar las causas y precisar soluciones, todo ello dentro del marco de legalidad atendible, en especial sobre el uso de recursos públicos y el ejercicio de las competencias públicas”.
Siendo también conforme al numeral 20 de la Ley General de Caminos Públicos, en calidad de propietaria, le corresponde a la actora, mantener limpios los desagües, en perfecto estado de servicio y libres de obstáculos. Postula que, el fundamento jurídico en el cual sustenta la actora sus pretensiones se encuentra incorrecto, por cuanto “las aguas pasan por su terreno a raíz del declive natural que las condiciones orográficas y topográficas presentan en el sitio, las cuales, dada esa naturalidad, no son susceptibles de expropiación e indemnización, en el tanto son servidumbres legales o naturales”. Con sustento en lo anterior, la representación de la Municipalidad de Orotina interpone las excepciones de falta de legitimación pasiva y la falta de derecho. Aunado, solicita que sea declarada sin lugar en todos sus extremos la demanda interpuesta por la señora [Nombre 002], y que se condene a ésta el pago de ambas costas del proceso. –
Del análisis de los autos, demanda y sus pretensiones, así como de los argumentos conclusivos efectuados durante la celebración de la audiencia del juicio oral y público, se deriva que el objeto del proceso gravita, por un lado, en la solicitud de que se declare la existencia de un funcionamiento anormal omisivo de la Municipalidad de Orotina, en cuanto a que no cumplió con llevar a cabo el proceso administrativo de expropiación, y consecuencia de ello, tampoco cumplir con su obligación de indemnizar a la actora por el terreno donde actualmente se encuentra instalada la servidumbre de aguas. Derivando en su argumentación una responsabilidad patrimonial de la Administración, como sustento para el pago de la expropiación del terreno que solicita, así como el daño por el remanente. Sin embargo, también se advierte que, no establece ninguna pretensión por daño patrimonial o moral adicional. Siendo ello así, pretende que este Tribunal condene a la Corporación Municipal al pago del área del terreno donde está ubicada la servidumbre de aguas, así como a pagar el daño producido por el remanente de la propiedad, montos que deben ser indexados y sobre los cuales deben reconocerse los intereses de ley, desde la toma de posición del terreno (15 de enero de 2004) y hasta el pago efectivo de la suma fijada.
En complemento a lo anterior, también requiere que se ordene una conducta (pretensión de hacer) al Gobierno Local, consistente en reparar la servidumbre que está en su inmueble, y le brinde una correcta y efectiva conducción de las aguas hasta el lindero norte. De ahí que, el análisis que realiza este Tribunal se efectúa sobre el marco fáctico y jurídico derivado del contenido de la demanda, la contestación de ésta y los argumentos de conclusiones de ambas partes efectuadas durante el Juicio Oral y Público, así como el análisis integral de los elementos probatorios admitidos, excluyendo los aspectos que han sido referenciados en el presente apartado. Desde esta perspectiva, en cumplimiento del principio dispositivo, esta Cámara Colegiada procederá a analizar las pretensiones objeto de la litis, y analizar los argumentos que en su criterio le asisten dentro del límite marco anteriormente expuesto. -
Siendo que, en el libelo de la demanda, la representación de la parte actora establece un elenco de pretensiones cuya redacción implica que en cada una de ellas, estén anidadas otras pretensiones conexas, esto es, en cada una de las pretensiones se erigen dos o más pretensiones consecuentes una de las otras, esta Cámara Colegiada a fin de poder realizar un examen integral de la causa petendi, procede a realizar un deslinde de éstas, clasificándolas y reagrupándolas. por lo que, el orden del análisis de las pretensiones sería el siguiente:
Como se apuntó en líneas anteriores, la actora sostiene que, mientras no se encontraba habitando su propiedad, el 15 de enero de 2004 la Municipalidad de Orotina, sin su autorización, construyó e instaló una servidumbre de aguas pluviales y servidas dentro de su propiedad, dispuesta de sur a norte, por todo el lindero este de dicho inmueble (de frente a fondo), continuando hacia la propiedad contigua que colinda al norte. Pretende que se declare por este Tribunal que su finca matrícula folio real N° 322557-000 del Partido de Alajuela está afectada por “una servidumbre de conducción de aguas”. Como parte de esta pretensión requiere que en sentencia se declare que la Municipalidad de Orotina fue quien afectó dicha servidumbre en su propiedad. Sobre estos argumentos, el Gobierno Local demandado gira su defensa en tres aspectos principalmente, el primero de ellos que, no fue la Municipalidad de Orotina quien instaló o construyó la tubería que está en el predio de la actora, sino que presume que fue el Instituto de Desarrollo Agrario (en adelante IDA), actualmente INDER, dado que dicha entidad pública ostentaba la propiedad de la finca matriz que fue fraccionada y vendida a favor de la actora, por lo que aduce la existencia de una falta de legitimación pasiva.
En segundo lugar, señala que, le corresponde a la empresa o entidad pública que está desarrollando un proyecto de vivienda (en este caso, sostiene fue disfrazado por el IDA como Asentamiento Agrario cuando en la práctica corresponde a una Urbanización), siendo para el caso en concreto, la Municipalidad de Orotina no fue quien desarrolló del Asentamiento, sino que fue el IDA, quien además no cumplió con los procesos correspondientes de aprobación del diseño de sitio, ni el otorgamiento de las licencias municipales para su construcción, así como tampoco fue sometido el pre-proyecto a su consideración, ni coordinaron con dicha Corporación Municipal lo correspondiente, referenciando una serie de prueba que comprueba lo dicho. Finalmente, manifiesta que la servidumbre sobre la cual pesa sobre el inmueble de la actora constituye a una servidumbre natural, donde aplica la Ley de Aguas, y al encontrarse sobre una vía pública, también le resulta aplicables las obligaciones contenidas en el numeral 20 de la Ley General de Caminos Públicos, respecto a mantener limpio y en funcionamiento el desagüe, de ahí que, no corresponde indemnización alguna.
CRITERIO DEL TRIBUNAL: Dicha pretensión debe ser acogida parcialmente por este Tribunal Contencioso Administrativo y Civil de Hacienda, en cuanto, exclusivamente se refiere a que, dentro de su propiedad está instalada una servidumbre de aguas. No obstante, respecto a las pretensiones adicionales consistentes en que sea declarado que, la Municipalidad de Orotina fue quien la construyó no se logró probar y debe ser rechazada, como consecuencia de ello, se acoge parcialmente la excepción de falta de legitimación pasiva incoada por parte de la Municipalidad demandada, por los motivos que se proceden a esbozar de seguido. De la prueba que está contenida dentro del expediente judicial en formato electrónico, y la que fue evacuada durante el juicio oral y público se desprende que es un hecho incontrovertido la existencia de una servidumbre de aguas pluviales que está ubicada en el lindero este del inmueble matrícula folio real N° 322557-000 del Partido de Alajuela, cuya titularidad le corresponde a la señora [Nombre 002].
(Ver Hecho Probado N° 15). Incluso se puede colegir de las fotos que son incluidas en el Informe Pericial rendido en la especie, que esta tubería en algunas partes, especialmente la que está contigua a la casa de habitación construida por la actora se encuentra expuesta, ubicándola durante la celebración del Juicio Oral y Público por parte del Ing. Luis Jonathan González Portuguez, por lo que se pudo corroborar por esta Cámara de Juzgadores de su existencia. Se suma a lo dicho que, también son contestes las deposiciones de los testigos que son funcionarios municipales y que han estado involucrados en el proceso, los señores Juan Pablo González Calderón, Javier Umaña Durán, y José Pablo Rojas respecto a su existencia dentro del inmueble de la actora. También se desprende del Informe Pericial, aspecto que no fue objetado por parte de la representación de la Municipalidad de Orotina, que dicha servidumbre cuenta con una medida de 121 m2 de ancho y largo, pesando sobre la propiedad de 800 metros que adquirió la actora en el año 1997.
(Ver Hechos Probados N° 3 y 15). Lo que se considera que está siendo un hecho controvertido es la naturaleza de dicha servidumbre, y los efectos que genera ésta sobre la situación jurídica material de la actora. Por ello, resulta relevante antes de continuar con el análisis de las demás pretensiones, analizar qué tipo de servidumbre es la que está en este momento dentro del bien inmueble de la señora [Nombre 002]. i) Aspectos Generales de las Servidumbres. Al respecto, se debe iniciar la exposición con la definición de lo que es una servidumbre, extremo que podría ser parte de las confusiones derivadas de la argumentación de la accionante, y sobre las que se adelante, hacen inviable su pretensión de indemnización. La servidumbre de forma general, como una figura que nace del derecho civil, se puede concebir como un “Derecho real consistente en el gravamen impuesto sobre un predio en beneficio de otro perteneciente a distinto dueño” (Muñoz Machado (Santiago).
Diccionario Panhispánico del Español Jurídico. España, Real Academia Española, Volumen I, 2017 p1890). Naturaleza como derecho real que tiene la característica de adherirse como parte indivisible de la propiedad, conforme a lo regulado en el numeral 224 en relación con los artículos 225 y 371 todos del Código Civil, al señalar este último que “Las servidumbres son inseparables del fundo a que activa o pasivamente pertenecen”. Así, la Sala Primera de la Corte Suprema de Justicia se han identificado precisamente las características de inseparables e indivisibilidad de las servidumbres, indicando que la primera consiste en que “son indisolubles al fundo al que activa o pasivamente pertenecen; así como su indivisibilidad en el sentido en que aun cuando el predio dominante se divida, las servidumbres subsisten íntegras, y los nuevos propietarios las gozarán, sin incrementar el gravamen del predio sirviente y si es éste el dividido la servidumbre permanece y cada uno de los predios segregados deben soportar en la parte correspondiente el ejercicio de esta.
Así lo ha desarrollado la Sala Primera de la Corte Suprema de Justicia, en el voto 017-F-99 de las 14 horas treinta 5 minutos del 20 de enero de 1999 y en igual sentido el voto no. 750-F-2000 de las 16 horas 30 minutos del 2 de octubre del 2002”. (Ver Resolución N° 120-2010 de las 8:30 horas de fecha 19 de noviembre de 2010). Aunado a lo expuesto, el precepto 370 del Código Civil se indica que pesan las servidumbres no por las personas, sino sobre los inmuebles donde se encuentran, lo que conlleva a que sea un derecho real. Ahora bien, en el caso de mérito la servidumbre bajo examen está instalada en la propiedad privada (de la actora), y conforme a los testimonios recibidos durante el Juicio Oral y Público del Perito y de los cuatro testigos evacuados son coincidentes que discurren las aguas provenientes de los habitantes del Asentamiento "El Vivero", es decir está afecto a un interés comunal (social, consistente en el Asentamiento anteriormente citado) y es parte de un sistema pluvial de éste.
Aquí debe realizarse una precisión, y es que, las servidumbres como derechos reales no implican per sé que estén destinadas a los objetivos de una entidad pública, sino que como se señaló está al servicio de un interés social, ese interés no es equivalente al interés del Estado o de un Gobierno Local, ni tampoco, como ha sido desarrollado por parte de la Sala Constitucional resulta contar con un contenido similar al sentido del interés público. Así el “El interés público no es el interés de un conjunto de habitantes tomados como masa; no es un bienestar general, omnipresente, una felicidad imprecisable; es sólo la suma de una mayoría de intereses individuales coincidentes y por ello la contraposición entre el interés público y el derecho individual es falsa si no redunda en mayores derechos y beneficios para los individuos de la comunidad. Por supuesto, hablamos de una mayoría de individuos, ‘o de la totalidad de los miembros de la sociedad.’ Debe tratarse, también, de intereses coincidentes lato sensu, esto es, homogéneos”.
(GORDILLO (Agustín). Tratado de Derecho Administrativo y Obras Selectas, Argentina, Editorial Fundación de Derecho Administrativo, 2013, pág. 408). Lo cual se encuentra em consonancia con el artículo 113 de la Ley N° 6227, Ley General de la Administración Pública, que fija principios que orientan la actuación de los servidores públicos a satisfacer, primordialmente, el interés público, “(...) el cual será considerado como la expresión de los intereses individuales coincidentes de los administrados”. Asimismo, dicho artículo refiere que “en la apreciación del interés público se tendrá en cuenta, en primer lugar, los valores de seguridad jurídica y justicia para la comunidad y el individuo, a los que no puede en ningún caso anteponerse la mera conveniencia”. (El resaltado no corresponde al original). Por su parte, en cuanto al concepto de interés social de la propiedad, la Sala Constitucional en la Resolución N° 000796-1991 de las 15:10 horas de fecha 26 de abril de 1991 postuló que: “En la Constitución de 1949 no se llegó a declarar la llamada ‘función social’ de la propiedad, pero si se mantuvo el mismo concepto de interés social de la propiedad, y tanto por la época en que esa regla fue incorporada al derecho constitucional patrio, junto con las garantías sociales, como por los motivos que impulsaron la reforma y por el sentido que desde años anteriores se daba a esa expresión de la literatura jurídica, no hay duda de que aquel concepto se identifica con los problemas de las clases sociales, acentuadamente las de menores recursos, y con las medidas que deben adoptarse para mejorar las condiciones económicas de esas clases y lograr que la convivencia humana se oriente hacia la consecución de un bien común y de justicia social ...”.
Sesión extraordinaria de Corte Plena del 25 de marzo de 1983.- Como se ve, el concepto de interés social es empleado en la Constitución con un sentido diferente al de interés público, y así debe entenderse porque la norma se introdujo como artículo 29 de la Constitución de 1871, junto con la reforma que adicionó en 1943 a la Constitución, el capítulo de garantías sociales, que es hoy el artículo 45 de la Constitución.-" Entonces cuando se hace alusión a ese interés social no es factible confundirse entre los intereses que perseguiría la Administración Local, las cargas o límites que son factibles ser impuestos a la propiedad para fines específicos, como pareciera desprenderse de la fundamentación de la demanda, en donde se indica que: “(…) en el presente caso resulta evidente que la demandada, en su carácter de institución pública, con el fin de dotar de salida a un problema de disposición de aguas (…); en virtud de la cual se encuentra en la obligación de procurarse el terreno suficiente para su construcción y utilización”.
Sobre lo cual, de seguido se analizará con mayor detalle, en cuanto a la naturaleza de la servidumbre, destino y efectos sobre la propiedad titular de la actora. ii) Análisis de la Pretensión Concreta. Retomando lo mencionado anteriormente, respecto al destino de interés social de las cargas y límites que puede imponer la ley al derecho fundamental de la propiedad, es criterio de esta Cámara de Jueces que esa servidumbre está al servicio de los habitantes del Asentamiento El Vivero, en donde discurren las aguas por una serie de cunetas y elementos pluviales que finalmente llevan a encausarse en una caja de registro que está a la entrada de la propiedad de la señora [Nombre 002]. Interés social que precisamente está por encima de un interés particular, dado que “(…) no hay posibilidad meramente lógica, de que existan derecho ilimitado, puesto que es la esencia misma del ordenamiento jurídico articular un sistema de límites entre las posesiones de todos los sujetos, y un subjetivo ilimitado podría ser causa de una destrucción del orden jurídico.
(…) Así la posición del carácter absoluto de la propiedad, como derecho ilimitado y exclusivos, sólo afectado por motivos de expropiación para construir obras públicas -única limitación admitida en el siglo pasado-, ha sido sustituida por una nueva visión de la propiedad, que, sin dejar de estar regulada como derecho subjetivo, prevé que sus poderes son limitados y que, además, está sujeta a deberes y obligaciones”. (Ver para mayor abundamiento, Resolución N° 2007-006581 de las 15:39 horas del 15 de mayo de 2007). No obstante, lo que no se logra extraer de la prueba aportada por parte de la actora es que la Municipalidad haya sido quien construyera o edificara el Asentamiento "El Vivero", ni tampoco logró acreditar que la servidumbre hubiera sido bajo la intervención del Gobierno Local. Incluso, no se trajeron elementos de convicción para que se determinara la fecha específica en que se instaló la servidumbre en el inmueble de la actora, por lo que no logró demostrar que en fecha 15 de enero de 2004 se hubiera construido la servidumbre.
Para probar estos hechos la actora ofreció el testimonio del señor Luis Fernando Araya Arguedas, sin embargo, éste no logró ubicar específicamente en su testimonio la fecha de la construcción de la servidumbre. En su testimonio referenció que es vecino de la actora, a la par de la propiedad. Indica que, no precisa con exactitud la fecha en que se pasó a vivir de forma definitiva en su casa, puesto que, en el momento de la entrega de las casas aún no había servicios básicos, entregaron las casas de forma incompleta. Indica que cuando ya se pasó a vivir, entre los años 2002 y 2003 ya las calles estaban terminadas, aunque eran de lastre. Ahora bien, si bien dicho testigo en su deposición manifestó a viva voz que fue la Municipalidad quien construyó la servidumbre en la casa de habitación de la actora, al preguntarle sobre cómo fue que llegó a esa conclusión, respondió que fue dado que vio los vehículos del Gobierno Local, sin embargo, no pudo determinar el nombre de las personas que estaban construyendo, aunque señaló que había trabajado en la Corporación Municipal años atrás, no pudiendo así circunstancialmente determinar si se trataba de la creación de la infraestructura que canaliza la servidumbre, o si se trató de una intervención sobre ésta, ya existente.
Bajo esta perspectiva, para los jueces que integran esta Sección el testimonio del referido señor se basó en supuestos, es decir, presumió que fue la Municipalidad quien instaló la infraestructura en la propiedad de la actora, pero no circunstanció, bajo criterios de modo y tiempo su dicho, por lo que no logra poder darle credibilidad para que con certeza se acredite la verisimilitud de su dicho. Además, tampoco la parte logró acreditar con otros medios probatorios como fotos, o documentos que dieran cuenta de que la Municipalidad construyó e instaló la tubería que está destinada como servidumbre de aguas. Más bien, hay dos aspectos que generan la duda a este Tribunal sobre la participación de ella en la instalación esa tubería. El primero de ellos, corresponde a que, en efecto, como lo probó la Corporación Municipal ella, no participó de ninguna fase previa ni durante el desarrollo del Asentamiento "El Vivero", ni tampoco coordinó previamente dicha institución con la Municipalidad de Orotina en ese momento.
Esta situación se prueba con los documentos aportados por la representación legal de la demandada, consistentes en el plano N° A-331685-96, correspondiente al Lote 27 del Proyecto "El Vivero", que constituye la finca matrícula folio real N° 322557-000 del Partido de Alajuela, en donde expresamente se lee que dicho proyecto es del Instituto de Desarrollo Agrario, particularmente de la Dirección del Registro Pacífico Central de esa entidad pública (Hecho Probado N°1), y de la escritura pública de las 10:00 horas de fecha 21 de marzo de 1997, en la que compareció el IDA en calidad de propietario y vendedor de dicho Lote 27 a favor de la señora [Nombre 002] (Hecho Probado N° 2). De estos hechos la parte actora no trajo contraprueba para desvirtuarlo. Tampoco ofreció prueba para desvirtuar que, en el año 1997 le fue entregado un bono de vivienda para la construcción de su casa. Este hecho es de vital importancia, porque si bien es cierto, se comprobó que para la construcción de su casa de habitación no se cumplió previamente con las licencias constructivas, lo cierto es que, del croquis contenido en el Informe Pericial efectuado por el Ing. González Portuguez, se colige que la casa de habitación se edificó, en parte, dentro del espacio de la servidumbre de aguas objeto de la litis.
Por lo que, bajo los criterios de la lógica, previstos en el numeral 16 de la Ley General de la Administración Pública, la construcción de la casa de habitación fue realizada de forma posterior a la instalación de dicha tubería en su propiedad, y no a lo inverso como pareciera derivarse del libelo de demanda. Ahora bien, otro de los aspectos que se logran demostrar es que, en el año 2007 aún no se habían entregado como parte del inventario de las vías cantonales las calles, y que el desarrollo urbanístico de "El Vivero" no había contado con autorización, aprobación o coordinación algunas con la Municipalidad de Orotina. Así se colige de la transcripción del Acuerdo VI, Inciso 1, Aparte 2 de la sesión ordinaria N° 60 celebrada el día 02 de enero de 2007, visible a imágenes 187 a 193 del expediente judicial en formato electrónico, (Ver Hecho Probado N° 5) pero además, del oficio N° AT-560-2007 de fecha 31 de julio de 2007 firmado por la Jefatura del Área Topografía del IDA, dirigida al Alcalde de ese entonces de la Municipalidad de Orotina, donde expresamente él indicó: “Como le comenté en algún momento vía telefónica; la Presidencia Ejecutiva del IDA me delegó coordinar con esa municipalidad, la identificación y posible traspaso de los caminos localizados en 9 sectores (Cebadilla, Santa Rita, Cerro Bajo, Cerro Alto, Mollejones, Vivero, Huacas, Cámara, Los Mangos) del proyecto Coyolar administrado por el IDA.
(…). Ante esta situación le estoy remitiendo copia de los planos mosaicos de dichos sectores”. (Ver Hecho Probado N° 6). Dichos hechos resultan ser contestes con las deposiciones de los señores Juan Pablo González Calderón, Javier Alberto Umaña Durán y José Pablo Rojas González, durante la Audiencia del Juicio Oral y Público, en donde todos logran establecer bajo criterios de modo, tiempo y lugar que el IDA no había coordinado previamente con la Municipalidad de Orotina, y no se siguieron los procedimientos dispuestos por el ordenamiento jurídico municipal para el desarrollo del Asentamiento "El Vivero", prueba de que, no intervino el Gobierno Local en las fases preliminares del proyecto. Por lo que, debe rechazarse por falta de elementos probatorios que lo demuestren que la Municipalidad de Orotina fue quien construyó o instaló la servidumbre de aguas en el inmueble cuya titularidad es de la señora [Nombre 002], acogiendo parcialmente, como se indicó la falta de legitimación pasiva interpuesta por la Municipalidad demandada, únicamente en lo que se alude a que, no trajeron elementos de convicción para determinar con certeza que fue ésta quien construyó o instaló la servidumbre en la propiedad de la actora.
En complemento a lo anterior, se considera relevante para definir qué tipo de servidumbre es la que pesa sobre el bien inmueble de la actora, determinar el régimen jurídico vigente en Costa Rica sobre las servidumbres de aguas y analizar por ende las pretensiones indemnizatorias. iii) Sobre el régimen de servidumbre de aguas en el ordenamiento jurídico costarricense: La representación legal de la demandada hace alusión a que, en la servidumbre de aguas de la actora es una servidumbre de carácter natural, con sustento en el artículo 94 de la Ley de Aguas, “en tanto las aguas pluviales, según las condiciones orográficas y topográficas del lugar donde se ubica el inmueble de la actora, se conducen natural e inexorablemente por esa propiedad (…). La simple inspección ocular, así como la prueba técnica aportada con este memorial, acredita que, en el lindero sur de la finca de la actora, que es la calle pública creada por el desarrollador del asentamiento ‘El Vivero’, existe pendiente natural que baja de este a oeste, de oeste a este y de sur a norte, teniendo como punto de encuentro dicha propiedad, lo cual implica que el desfogue natural”, y posteriormente refiere a que es “deber del propietario, conforme con el 20 de la Ley General de Caminos, cuando sus fundos estén inmediatos a los desagües de un camino, mantener éstos limpios, en perfecto estado de servicio y libres de obstáculos los desagües de un camino que estén inmediatos”.
Y la accionante hace alusión a que la servidumbre de aguas en su propiedad no cuenta con efectos registrales. CRITERIO DEL TRIBUNAL: Sobre estos extremos, se denota que existe una confusión entre los diferentes tipos de servidumbres que pueden establecerse sobre un bien inmueble, y sobre los efectos que éstas tienen sobre la titularidad de un bien, por lo que se precisará en términos generales algunas características de las servidumbres, en complemento a lo ya expuesto en líneas anteriores sobre las limitaciones al derecho a la propiedad privada, y se aludirá a la clasificación de la servidumbre que se encuentra dentro del bien inmueble folio real N° 322557-000 del Partido de Alajuela. El Código Civil nos refiere a que las servidumbres pueden ser continuas no aparentes o aparentes, o discontinuas, pero también existen servidumbres naturales como legales, voluntarias y forzosas, temporales y perpetuas.
Y dependiendo de su naturaleza así son los efectos legales que tienen, y se regula en el ordenamiento jurídico legal su forma de constituirse, por ejemplo, en el numeral 378 del Código Civil, se establece que “Las servidumbres que son continúas y aparentes a la vez, pueden constituirse por convenio, por última voluntad o por el simple uso del uno y paciencia del otro”; a diferencia de “Las servidumbres discontinuas de toda clase y las continuas no aparentes, sólo pueden constituirse por convenio o por última voluntad. La posesión, aun la inmemorial, no basta para establecerlas”. De ahí que, no lleva razón la actora de que el hecho de que una servidumbre deba ser en todos los casos inscrita en el Registro Nacional, por cuanto en algunos casos incluso puede constituirse por un convenio entre las partes, de forma natural o legal. (Para mayor abundamiento sobre los tipos de servidumbres ver Resoluciones N° 26 de las 8:30 horas del 16 de marzo de 1991; N° 750 de las 16:30 horas del 02 de octubre del 2002 y N° 00890-2006 de las 10:00 de fecha 10 de noviembre de 2006 de la Sala Primera de la Corte Suprema de Justicia).
También existen diferentes destinos de las servidumbres, pueden ser ferroviarias, mineras, petroleras, aguas, paso, eléctricas, entre otras, cada una de las cuales tienen su propia regulación legal y, por ende, hay que remitirse a ésta para poder determinar cuáles son las dimensiones, particularidades y efectos que conllevan sobre la propiedad privada. En el caso de las servidumbres de aguas, como las que se describen en los hechos de la demanda, pueden referirse a dos normas jurídicas donde se encuentran reguladas, la Ley de Aguas y la Ley General de Caminos Públicos. En la primera norma legal, se contemplan dos tipos de servidumbres: las naturales (artículos 94 a 98) y las legales (Sección II, artículos 99 y siguientes). En el numeral 94 de la Ley de Aguas, se norman expresamente las servidumbres naturales, de la siguiente forma: “Los terrenos inferiores están obligados a recibir las aguas que naturalmente, y sin intervención del hombre, fluyan de los superiores, así como la tierra o piedras que arrastren en su curso.
Pero si las aguas fuesen producto de alumbramientos artificiales, o sobrantes de acequias de riego, o procedentes de establecimientos industriales que no hayan adquirido esta servidumbre, tendrá el dueño del predio que recibe las aguas el derecho de exigir el resarcimiento de daños y perjuicios, a menos que éste quiera aprovecharse de las aguas que reciba su terreno, en cuyo caso no tiene derecho a tal resarcimiento. (…)”. Como se desprende de la literalidad de lo transcrito, se reputará que existe una servidumbre natural cuando no haya intervención del ser humano, sino que de la misma fuerza o topografía del terreno conlleve a que discurran sobre un inmueble específico, lo que implica que su propietario debe soportarlas. Ahora bien, según el criterio de la Sala Primera de la Corte Suprema de Justicia, lo cual es compartido por este Tribunal, en la Resolución N° 890-2006 de las 10:00 horas del 10 de noviembre de 2006, “lo preceptuado en ese ordinal es una servidumbre impuesta por disposición legal”, ergo no tiene un derecho indemnizatorio en su favor, ni tampoco genera que debe ser expropiada por la Administración.
En el caso de las regulaciones de la Ley General de Caminos, (en adelante pudiendo abreviarse como LGC) se consagra en su numeral 20 que: “Todos los poseedores de bienes raíces, por cualquier título, están obligados a recibir y dejar discurrir dentro de sus predios, las aguas de los caminos cuando así lo determine el desnivel del terreno y, cuando sus fundos estén inmediatos a los desagües de un camino, deberán mantener estos desagües limpios, en perfecto estado de servicio y libres de obstáculos. El Ministerio o las Municipalidades mandarán a ejecutar el trabajo y cobrarán el trabajo más el cincuenta por ciento (50%) de recargo, si esta obligación no se cumpliere. El Ministerio de Obras Públicas y Transportes y las Municipalidades deberán coordinar con el Ministerio de Agricultura las medidas de protección de los caminos en los proyectos de nuevos trazados o en los trabajos de conservación de los existentes, en las regiones donde los mismos puedan provocar o intensificar la erosión o desviar el desagüe natural de los campos”.
Tres aspectos que logran deducir de la literalidad de dicha norma, primero, que deben ser servidumbres donde discurren aguas de caminos públicos; segundo que, el agua discurra de forma natural según el desnivel del terreno; y tercero que, los fundos deben estar inmediatos al desagüe del camino. Siendo que, en el caso en concreto la servidumbre de aguas se produjo por la intervención humana, dado que fue producto del desarrollo del Asentamiento "El Vivero", (ver Hecho Probado N° 2, en donde se refiere a que el IDA, actualmente el INDER, reunió, para luego fraccionar y entregar mediante venta de lotes a favor de una serie de personas, entre éstas la señora [Nombre 002]), así como que está frente a calle pública (Ver Hechos Probados N° 1 y 2 en relación con los Hechos Probados N° 11, 14 y 15), se deriva que no se está en presencia, actualmente ante una servidumbre natural regulada por la Ley de Aguas, sino que sería una de carácter legal de camino público, regulada por la LGC.
Lo anterior sin que ello implique que se niegue la existencia previa de una servidumbre natural de agua, por cuanto de los elementos probatorios traidos al expediente judicial se logra advertir que, el desnivel existente en el lindero sur con dirección hacia el lindero norte de la propiedad de la actora existía previamente, según el testimonio del señor Jose Pablo Rojas González, Ingeniero Topógrafo, cuya declaración resulta ser convincente, espontánea y con credibilidad ante esta Cámara de Juzgadores. En el siguiente apartado, analizaremos esos tres parámetros en el caso en concreto. iv) Análisis sobre la naturaleza de la servidumbre de agua ubicada en la propiedad de la actora. Para efectos de fundamentar el criterio de esta Cámara de Juzgadores respecto de la calificación de la servidumbre objeto del presente proceso, se procederá a analizar los tres aspectos anteriormente mencionados que se desprenden del numeral 20 de la LGC anteriormente reseñados. a) Se indicó que, deben ser servidumbres donde discurren aguas de caminos públicos.
Como se adelantó líneas arriba, la propiedad de la actora en el lado sur colinda con calle pública, lo cual da fe tanto el plano catastrado N° A-331685-96 perteneciente a la propiedad de la actora, como la Certificación Literal de la finca matrícula folio real N° 322557-000 del Partido de Alajuela, (Hechos Probados N° 1, 2 y 3). Ese lindero sur es donde inicia el trayecto de la servidumbre y donde se encuentra la caja de registro frente de la propiedad de la actora, lo cual se logra colegir del Informe Pericial rendido para el caso en concreto y de la deposición del Perito Judicial designado. (Ver Hechos Probados N° 14 y 15). También, se demostró en la especie, que es una calle pública que está al frente de la propiedad de la actora, corresponde a un bien municipal, según el inventario que fue efectuado en el año 2007 por parte de la Corporación Municipal (Ver Hecho Probado N° 18), con lo que la tesis municipal de que el proyecto del Asentamiento "El Vivero" no ha sido “formalmente” entregado, no puede considerar que sea respecto a las calles o vías de ésta, ello por el hecho de que, al ser incorporada en la red vial cantonal, en aplicación del principio de inmatriculación, pasa la vía (así como las estructuras que la acompañan incluyendo cunetas y todo el sistema pluvial) a ser administradas por el Gobierno Local.
Por lo que, conforme a la clasificación dispuesta en la Ley General de Caminos, numeral primero, es parte de la red vial cantonal, cuya administración le compete a ésta, cumpliéndose el primer criterio estipula en dicha norma legal. b) Otro de los aspectos que deben cumplirse según la transcripción de la norma citada, es que “los fundos estén inmediatos a los desagües de un camino”, lo cual también se corrobora con los elementos de convicción que fueron traídas por las partes al presente proceso. En este sentido, fueron contestes los testimonios de los cuatro testigos, respecto a que las aguas del Asentamiento "El Vivero" discurren por las calles públicas hacia la propiedad de la actora, entrando por la caja de registro frente a su propiedad, de lo cual también concuerda con la deposición recibida en el Juicio Oral y Pública del Perito Judicial, y que ésta no resulta inconexa del sistema pluvial del sitio, dado que, según la deposición del topógrafo municipal, la canalización de las aguas discurren por el fundo posterior que colinda con el terreno de la actora, para reconectarse con otra sección del sistema pluvial para finalmente desembocar en un cuerpo de agua (quebrada).
El croquis confeccionado por el Perito Judicial determina la existencia de una caja de registro, como se indicaba líneas arriba que está en la calle pública, colindancia sur de la propiedad de la actora, (Ver Hechos Probados N° 15 y 16). Incluso en las mismas conclusiones que fueron esgrimidas por ambas partes durante el Juicio Oral y Público concuerdan en el hecho de que las aguas discurren hacia la propiedad de la actora, provenientes del Asentamiento "El Vivero", y el señor Luis Fernando Araya Arguedas, vecino de la actora, refiere a la existencia de dicha caja de registro, lo que denota que esté contiguo a su propiedad. De ahí que este elemento, establecido en la norma para que configure una servidumbre legal contenida en el numeral 20 de la LGC se logra corroborar. c) El otro elemento, corresponde a que, “así lo determine el desnivel del terreno”, lo cual se logró comprobar en la especie.
Esta conclusión se deriva de los resultados del Informe Pericial rendido en fecha 10 de octubre de 2022 por el perito judicial designado, el Ing. González Portuguez. En el croquis inserto en dicho informe se colige que, la propiedad de la actora, finca matrícula folio real N° 322557-000 del Partido de Alajuela muestra un desnivel dirección de sur a norte, determinándose que frente a la casa (calle pública) de la actora corresponde a un nivel de 99.14 y hacia el fondo de su propiedad se encuentra a un nivel de 96.767, por lo que en efecto existe un desnivel (declive hacia abajo), donde la parte del frente está más elevada que el fondo del inmueble titular de la señora [Nombre 002] (Ver Hechos Probados N° 13, 14, 15 y 16). Lo anterior, también se extrae de las deposiciones rendidas por los señores Javier Alberto Umaña Durán y José Pablo Rojas González, en el Juicio Oral y Público, las cuales fueron coincidentes y espontáneas, si bien apuntaron que el desnivel era superior al señalado por el Perito Judicial, lo cierto es que concuerda su testimonio con la existencia de un desnivel desde los otros puntos cardinales hacia la finca propiedad de la actora.
Incluso el señor José Pablo Rojas González, Ingeniero Topógrafo de la Municipalidad de Orotina reseñó en términos generales que, realizaron un levantamiento topográfico en la zona, para determinar la existencia de las curvas de niveles, en relación con las calles y cunetas del Asentamiento "El Vivero". Indicó que, en éste hay varias de caja de registro. Tomaron del registro de frente de la propiedad de la accionante, empleando una metodología de curvas de nivel de cada 25 centímetros y hacia la siguiente caja de registro que se encuentra en dirección sur-norte del inmueble dicho, determinado un desnivel de 6,62 metros con respecto a la calle siguiente. Lo que como resultado arroja que, la infraestructura de la caja de registro que se encuentra frente a la propiedad de la señora [Nombre 002] corresponde al punto más bajo, por lo que, de forma natural, transcurren todas las aguas de las vías públicas y cunetas hacia donde está la caja de registro del frente de la finca matrícula folio real N°322557-000 del Partido de Alajuela.
Ante la consulta efectuada por este Tribunal, señaló que, precisamente la problemática que se está presentando con el inmueble objeto de disputa es que, las curvas de nivel de todo el terreno, desde la calle pública van hacia un declive, de forma tal que, desde las colindancias sur, este y oeste del inmueble de la accionante convergen las aguas hacia la caja de registro frente a éste. De esta situación de la morfología del inmueble, es coincidente con la información que registra el mapa de curvas de nivel efectuado en el mes de noviembre de 2021 por parte de la Municipalidad de Orotina, visible en la carpeta adicional del expediente judicial y que tuvo a la vista este Tribunal. E informó el referido Ingeniero Topógrafo Municipal a esta Cámara de Juzgadores en el Juicio Oral y Público que, tuvieron como insumos las curvas de nivel del año de 1987, donde se muestra un desnivel similar al determinado por el estudio topográfico realizado.
Paralelo a lo dicho, también se logró demostrar que la Municipalidad de Orotina realizó una serie de labores de mantenimiento a las calles, cunetas y las cajas de registro del Asentamiento "El Vivero" (Ver Hechos Probados N° 11 y 12). Sin embargo, manifestaron los funcionarios municipales admitidos como testigos que, dichas obras se basaron en la propia morfología del terreno, específicamente de la infraestructura que ya existía en el lugar, no modificando la distribución y el diseño de sitio que fue establecido por el desarrollador, sino que se realizaron obras de mantenimiento y mejoras tomando como partida lo ya existente. En virtud de lo anterior, se corrobora el cumplimiento del tercer parámetro establecido en el numeral 20 de la Ley General de Caminos, concluyéndose que es esa norma la aplicable para el caso en concreto. Continuando esta exposición a fin de analizar las pretensiones aducidas por la accionada, el hecho que esta norma se aplique al caso en concreto, implica dos aspectos de relevancia, el primero de ellos la obligación del titular del fundo sirviente donde discurren las aguas de las calles públicas de mantener estos desagües limpios, en perfecto estado de servicio y libres de obstáculos.
En segundo lugar, tienen el deber legal de soportar esa carga, lo que excluye que, por ésta debe sufragarse indemnización alguna. Así, la Sala Primera de la Corte Suprema de Justicia ha establecido que debe soportar del desfogue de las aguas, siempre que sea un flujo razonable (Ver Resolución N° 00297-2017 de las 15:40 horas de fecha 16 de marzo de 2017), en virtud de la función social de la propiedad anteriormente aludida, y siendo que existe una norma jurídica que establece dicha carga. De seguido se profundizará sobre este tema en relación con las demás pretensiones. - 3. SOBRE LA PRETENSIÓN DECLARATIVA LA OMISIÓN DE LA MUNICIPALIDAD DE OROTINA DE CUMPLIR CON EL PROCEDIMIENTO DE EXPROPIACIÓN Y SU RESPECTIVO PAGO DEL JUSTIPRECIO.
Como se ha manifestado anteriormente, la pretensión principal indemnizatoria parte de la existencia de una omisión por parte del Gobierno Local demandado, consistente en que, a criterio de la señora [Nombre 002], debió de haberse expropiado la franja de su propiedad en donde pesa la servidumbre de aguas, así como indemnizar el daño ocasionado al remanente. Indica en el memorial de fecha 03 de setiembre de 2021 -en donde se ajustaron los hechos de la demanda- que, “Por esta constitución de servidumbre la MUNICIPALIDAD DE OROTINA no realizó gestión alguna del debido proceso expropiatorio, que por imperio de ley debió de realizar, tampoco solicitó el permiso y mucho menos a pagado el valor de los terrenos de hecho y afectados. (…) la demandada ha transgredido el debido proceso y ha violentado el artículo 45 constitucional, la Ley General de Expropiaciones y la Ley General de la Administración Pública”.
Continúa esgrimiendo que, el Estado se encuentra constreñido a responder por los daños y perjuicios que pueden producir todos y cada uno de sus actos, responsabilidad que está revestida de carácter objetiva, transcribiendo los artículos 9 y 41 de la Constitución Política y numerales 190 y 191 de la Ley General de la Administración Pública, y referenciando que la responsabilidad civil del Estado nace independientemente de la existencia de la culpa o dolo del funcionario público. Luego hace alusión al numeral 1048 del Código Civil y que para individualizar la aplicación de esta responsabilidad al caso en concreto, señala que el Gobierno Local, a fin de buscar una solución a la disposición de las aguas, decide realizar la construcción de la servidumbre en su propiedad “en virtud de la cual se encuentra en la obligación de procurarse el terreno suficiente para su construcción y utilización, porque mantenimiento no le da, lo cual implica la imposición de una serie de restricciones para construir, acumular materiales, sembrar árboles u obstaculizar la franja de terreno que comprende; situación que constituye una importante limitación a los tributos esenciales de propiedad por cuanto me impide el libro uso y disposición de mi predio”.
Citando los numerales 45 constitucional y 13 de la Ley de Expropiaciones. CRITERIO DEL TRIBUNAL: Retomando lo que se ha sostenido a lo largo de la presente resolución, no se pone en duda sobre la inviolabilidad de la propiedad privada, como “aquel derecho de poseer exclusivamente una cosa, gozar y disponer de ella, sin más limitaciones que las establecidas por la ley o por la voluntad del propietario”. (Ver Resolución N° 2006-017514 de las 9:41 horas de fecha 01 de diciembre de 2006 emitida por la Sala Constitucional de la Corte Suprema de Justicia). También se reconoce, posición que se comparte, que: “El tratamiento de la protección de los derechos reales, en materia civil y agraria, tienen una gran importancia en todos los ordenamientos jurídicos que han consolidado una base constitucional arraigada en la protección de los derechos humanos fundamentales: junto a los derechos de libertad económica, entre los cuales se encuentra la propiedad privada y demás derechos reales derivados, también se han consagrado derechos-deberes económicos, sociales y ambientales.
La propiedad privada y la libertad económica encuentran protección constitucional en los artículos 45 y 46 de nuestra Carta Magna y, aunque parece obvio, su existencia y defensa obedecen a la permanencia de un Estado Social de Derecho, basado en principios y valores constitucionales, en los cuales se consagran no solo derechos a favor de los particulares, sino también deberes, con miras a alcanzar un desarrollo económico, con equidad, solidaridad y justicia social”. (Ver Sala Constitucional Resolución Nº 16629 -2012 a las 16:31 horas 28 de noviembre del 2012). No obstante, lo que no se puede perder de vista es que el ordenamiento jurídico como un todo, consagra un balance o un equilibrio entre los derechos de los administrados, las garantías dispuestas en procura de la protección al régimen de libertades, dentro de las que se encuentra, como dijimos anteriormente, el derecho fundamental a “tener” (propiedad privada), y el interés general, público y la propia función social de la propiedad, soportando cargas no indemnizables.
También se trae a colación lo ya apuntado, en lo concerniente a que, por estos motivos, y la propia evolución del concepto de la propiedad, es que jurídicamente es factible que la propiedad tenga cargas, límites o limitaciones que pesan sobre el bien inmueble, y respecto de las cuales, unas deben ser soportadas por su titular sin pretender ser indemnizado, como lo son las servidumbres legales. Sin pretender profundizar el tema, a nivel de jurisprudencia de la Sala Constitucional y de la Primera de la Corte Suprema de Justicia se ha determinado que la imposición de servidumbres legales como lo corresponde a la prevista en el numeral 20 de la Ley General de Caminos Públicos, norma que regula la servidumbre que pasa por la propiedad de la actora, tiene un asidero histórico, como parte de la dicotomía de ideologías respecto del contenido y alcances de la propiedad privada. Así se procede a transcribir, aunque un poco extensa la posición que esgrimió nuestro Tribunal Constitucional sobre las servidumbres legales: “No obstante lo anterior, aunque el origen de sus disposiciones obedece a dos orientaciones ideológicas diversas y aparentemente antagónicas, al hacerse la lectura del artículo 45 Constitución Política de mil novecientos cuarenta y nueve, debe interpretarse y aplicarse de manera integral, con sustento en las nuevas orientaciones y corrientes del Derecho.
De esta suerte, al establecer el párrafo primero que ‘la propiedad es inviolable’, no puede entenderse que define el concepto de propiedad absoluta e intocable que ha pregonado y sustentado la ideología del liberalismo económico; a partir de la cual se concibió a la propiedad como una institución del derecho natural, en el tanto se le entendió como una extensión de la personalidad, toda vez que es el individuo quien cumple su función social, de donde cada individuo dueño de la utilidad y provecho de su propiedad, es decir, que el hombre, para lograr el desenvolvimiento de todas sus facultades, necesita ejercer el predominio sobre el mundo exterior, usar y apropiarse de las cosas que requiere para cumplir este objetivo. Efectivamente, a partir de esta concepción se le tuvo como uno de los derechos más significativos en la primera etapa del constitucionalismo (como derecho de primera generación), por el que se conforma como el derecho real por excelencia, en tanto todos los otros derechos no son más que emanaciones de éste, formas parciales del dominio, incapaces, por sí mismas, de dar plenitud de goce.
Por ello, los juristas lo definieron como ‘el derecho en virtud del cual una cosa queda sometida de modo absoluta y exclusivo a la voluntad y acción de una persona’. En este marco ideológico es que, si resultan legítimas las limitaciones a la libertad política, pero no así a la libertad económica o empresarial. Este concepto encuentra sus orígenes en el Derecho Romano, que la definió como el derecho de obtener de un objeto toda la satisfacción que éste pueda proporcionar, cuya extensión se extendía del subsuelo -’usque ad inferna’- al espacio aéreo -’usque ad coela’-. Las únicas limitaciones que se admitían eran las ‘servidumbres legales’, que implicaron un tolerar o no hacer, como lo son el derecho de paso, o recolección de la fruta caída, y las básicas del derecho urbanístico, recogidas -en su mayoría- en nuestro Código Civil; por ejemplo las que se refrieren a la posesión y transmisión de inmuebles -artículo 272-, en virtud de las que se impide la división en caso de copropiedad; las referidas a la altura de las aceras -artículo 303-; las que establecen la protección por los posibles daños causados a terceros por el mal estado de las edificaciones o árboles -artículo 311-; y en especial todo el título V llamado de las Cargas o Limitaciones a la Propiedad Impuestas por Ley, en el que se fijan, entre otras, las prohibiciones de construir cerca de pared medianera, pozos, cloacas, acueductos, etc., -artículo 404-, las que prohíben abrir ventana o claraboya en pared divisoria, a menos de dos metros y medio por lo menos -artículo 406-, o que den vista a habitaciones, patios o corrales del predio vecino -artículo 407-”.
(Ver Resolución N° 2007-006581 de las 15:39 horas de fecha 15 de mayo de 2007 de la Sala Constitucional). Bajo este orden de ideas, lo que se deriva de la argumentación y correlativa pretensión indemnizatoria por parte de la actora, es precisamente, por un lado, que desconoce que la servidumbre que se encuentra en su propiedad es de carácter legal, y por otro lado, intenta requerir una indemnización a través de la expropiación, confundiendo a su vez, los alcances de la expropiación, y cuándo es que jurídicamente una limitación, límite o carga a la propiedad implica vaciar el contenido al derecho de propiedad, situaciones en las cuales, sí debe indemnizarse. Por lo anterior, consideramos realizar una distinción entre ambos institutos. I Distinción entre los institutos del procedimiento de expropiación y las servidumbres (derecho real de goce). Siendo que ya, de forma sucinta se ha analizado las servidumbres como un derecho real de goce, se procede a describir brevemente la figura de la expropiación.
La Ley de Expropiaciones, en su numeral primero, brinda una serie de pautas sobre la expropiación y su régimen jurídico, indicando que: “La presente ley regula la expropiación forzosa por causa de interés público legalmente comprobado. La expropiación se acuerda en ejercicio del poder de imperio de la Administración Pública y comprende cualquier forma de privación de la propiedad privada o de derechos o intereses patrimoniales legítimos, cualesquiera sean sus titulares, mediante el pago previo de una indemnización que represente el precio justo de lo expropiado”. (El resaltado no corresponde del original). Se reitera que, la Sala Constitucional y el marco jurídico constitucional y legal costarricense es muy claro respecto a que pueden fijarse por ley una serie de limitaciones a la propiedad en tanto, “la propiedad no sufra desmembraciones que hagan desaparecer del derecho, toda vez que se mantiene el uso natural del bien y su valor económico en el mercado.
Asimismo, se aclara que las limitaciones o restricciones a la propiedad son de carácter general, y tienen la virtud de dotar al individuo de los instrumentos necesarios para paliar los efectos de la actividad perjudicial de sus congéneres. Cabe señalar que tiene como finalidad u objetivo el uso racional de la propiedad, con lo que se benefician los vecinos o, en general toda la sociedad, obligación que se encuentra su sustento (a modo de justificación) en la consideración de que resultan imprescindibles para la convivencia en sociedad, no tratándose de una actividad expropiatoria que requiera de indemnización previa, en los términos exigidos y previstos en el párrafo primero del artículo 45 de la Constitución Política”. (Ver Resolución N° 2007-0006581 de las 15:39 horas de fecha 15 de mayo de 2007, ya citada). De lo transcrito, muy brevemente se puede inferir que la expropiación “per se”, conlleva a una privación de la propiedad privada, o de sus derechos como lo es, la utilización o disfrute de la cosa, que es precisamente lo que líneas arriba indicamos como un marco infranqueable de la imposición de una carga, límite o limitación, el no vaciar de contenido el derecho de la propiedad, por cuanto, cuando la limitación es de tal magnitud ya sea por su contenido o el tiempo (como la afectación temporal de la propiedad, que la Sala Constitucional ha señalado que es un congelamiento que debe ser indemnizado, ver Resolución N° 2007-005598 de las 15:47 horas de fecha 25 de abril de 2007), implica una carga mayor y un desbalance del equilibrio entre los derechos y garantías de los ciudadanos y las potestades del Estado (aunque sean amparadas en un interés público, de hecho se parte de la existencia de un de interés público como presupuesto para su actuación), por lo que, se está en el supuesto de un acto expropiatorio, privativo de la propiedad, consecuentemente nace el deber de indemnización.
La teoría del caso de la actora confunde el párrafo primero del numeral 45 constitucional, con su párrafo segundo, los dos son distintas sus regulaciones. En el primer párrafo se regula la privación completa de la propiedad o de los derechos que se ostenta en calidad de propietario de un bien, en donde previa determinación de un interés público que lo posibilita se despoje del bien a un particular, para transformarlo en otro bien destinado al interés público general, y el párrafo segundo, donde se prevé la función social de la propiedad, y la posibilidad de establecerse limitaciones y cargas, cuya validez o legitimidad resulta “cuando es necesaria para hacer posible ‘la vigencia de los valores democráticos y constitucionales’; de manera que, además de útil, debe ser necesaria, razonable y oportunidad, y debe implicar la existencia de una necesidad social imperiosa que la sustente, y por ende, excepcional; por lo cual, deben estar llamadas a satisfacer un interés público imperativo.
La razonabilidad de la limitación se traduce en su adecuación al fin y al interés (valor) que la justifica; y f.- Las limitaciones no son indemnizables en tanto no implican desmembramientos que hagan desaparece el derecho; la cual está prevista únicamente para hacerle frente a la pérdida de la propiedad (expropiación)”. (Ver Resolución N° 2007-006581 de la Sala Constitucional anteriormente citada). Esa privación de la propiedad, como lo afirma la parte actora, no se logra demostrar en la especie, por lo que se adelanta, que deviene en rechazo tanto en que se deba realizar un procedimiento de expropiación, así como el pago de su justo precio. El yerro de que parte la teoría del caso de la accionante es que, con el hecho de que se haya impuesto una servidumbre, deviene en un limitación que le impide hacer uso y goce de su propiedad vaciando el contenido de su propiedad, lo cual por el hecho de la mera imposición de la servidumbre por la ley, no le genera ese efecto, como reiteradamente se ha indicado en esta exposición, debe acreditarse que es de tal magnitud que le impide su libre uso y disfrute, lo cual no ha sido demostrado por la parte actora, teniendo la carga probatoria (artículo 41.1 del Código Procesal Civil, norma civil aplicable al caso en concreto por el numeral 220 del CPCA).
Como se había señalado antes, quien alega una pretensión debe probar los elementos constitutivos de su derecho, trayendo elementos de convicción al proceso, para demostrar que se le ha vaciado de contenido su propiedad, lo cual no hay prueba alguna que obre en el expediente que permita acreditar el dicho de la accionante. De hecho, véase que de forma espontánea (lo cual es plena prueba a la luz del 41.3 del Código Procesal Civil) la parte actora apunta que la servidumbre tiene un efecto continuado y que lleva 17 años de haber sido instalada. Y la actora ha estado viviendo en su habitación (sin precisar fecha) sin que le haya impedido poder utilizarla como vivienda, que es el destino para el cual la ha estado empleando. Adicionalmente, refiere a que tiene una serie de restricciones "para construir, acumular materiales, sembrar árboles u obstaculizar la franja de terreno que comprende”; situación que en su criterio alega que constituye una importante limitación a los atributos esenciales de propiedad por cuanto impide el libre uso y disposición del predio, pero éstas restricciones no logran ser probadas en cuanto a que impliquen "una importante limitación a su propiedad", ni que sean desproporcionadas o irrazonables sus obligaciones provenientes de dicha servidumbre, por lo que no se comparte el dicho de la accionante respecto a que exista una obligación de la Municipalidad consistente en expropiar dicha servidumbre.
Es decir, no se logra identificar un funcionamiento anormal omisivo de la Corporación Municipal de cumplir el debido proceso de expropiación, puesto que como se indicó en líneas anteriores, la servidumbre que pesa sobre la propiedad de la actora constituye a una servidumbre de carácter legal, y no demuestra que le esté vaciando o desmembrando el contenido de su derecho derivado de su condición de titular, aspecto que debió ser probado por la accionante. Incluso como se indicó anteriormente, dentro del espacio de 121 m2 de la servidumbre, según el Informe Pericial presentado por el señor Luis Jonathan González Portuguez, se identifica que hay una parte de la servidumbre que en su momento fue subterránea, donde está construida encima su casa de habitación, siendo lo anterior, un elemento de prueba que no fue refutado por la parte actora, no logra determinarse por esta Cámara de Jueces en qué consiste la afectación que le impide el goce y disfrute de su propiedad, de forma tal que se produzca como indica, “una grosera limitación”.
Y es que, como se esgrimió “Como consecuencia de la imposición de una servidumbre administrativa, no se produce alteración alguna en la condición legal del propietario: Éste sigue siendo tal, y puede utilizar la cosa, pero respetando la servidumbre creada, sin violar las obligaciones que la ley le impone. (…) Destacamos que la imposición de una servidumbre administrativa (o civil, pues en esto no difieren) sobre una propiedad privada, no priva al propietario del uso de la cosa, sino que le obliga a soportar el uso conjunto que la autoridad pública efectúa, y a usarla él mismo de acuerdo a las condiciones impuestas por la ley. Si se quisiera establecer una “servidumbre” que privara completamente al propietario del uso de la cosa, transfiriéndolo en su totalidad al uso público, se trataría en realidad de una expropiación y no de una servidumbre”. (Gordillo (Agustín). Derecho Administrativo de la Economía.
Buenos Aires, Argentina, Ediciones Macchi, Tomo XVIII. 1967, págs. 376 y 377). Y para determinar que no se está ante una servidumbre, sino que por sus efectos conlleva implícita una expropiación debe la parte que lo alega demostrarlo, con prueba que cumpla con los requisitos establecidos en la normativa vigente, como idónea, útil y necesaria (artículo 41.3 del Código Procesal Civil), aspecto que se echa de menos por parte de este Tribunal, y que sustenta que deba declararse sin lugar, tanto la pretensión de que se declare que la Municipalidad de Orotina omitió realizar el proceso de expropiación de la franja de terreno donde se encuentra la servidumbre como la correspondiente indemnización, por esa limitación o carga que fue establecida por el ordenamiento jurídico (numeral 20 de la Ley General de Caminos Públicos). II. Sobre la distinción entre la responsabilidad administrativa y la expropiación.
Otro de los fundamentos que esboza la señora [Nombre 002] en el libelo de la demanda, es que la Municipalidad es responsable patrimonialmente, transcribiendo los numerales 9 y 41 de la Constitución Política, y 190 y 191 de la Ley General de la Administración Pública. Sin embargo, esa fundamentación parte de que el justiprecio, esto es, el monto que la Administración paga producto de una expropiación es equivalente a la indemnización dispuesta en la Ley General de la Administración, lo cual es inexacto. De forma preliminar, se comparte la tesis de la actora que, conforme a la jurisprudencia emitida por la Sala Primera de Justicia anteriormente citada, ha quedado establecido que, en Costa Rica, del artículo 41 de la Constitución Política, en relación con los numerales constitucionales 9, 11 y 33, existe un régimen de responsabilidad preeminentemente objetiva del Estado, donde se desplaza todo el sistema a favor de la persona (administrado), quien ya no debe probar elementos subjetivos del funcionario público para lograr que se le indemnice de una conducta pública que le produjo un daño, de forma tal que ahora la carga de la prueba es de la Administración quien debe descargarse sobre los hechos que se le imputan, así, “En tanto se haya sufrido una lesión como consecuencia de una conducta pública, sea esta activa u omisiva, que no tiene el deber de soportar, se impone el deber de resarcimiento, en virtud del principio de reparación integral del daño que se desprende del numeral 41 de la Constitución Política”.
(Sala Primera de la Corte Suprema de Justicia, Resoluciones N° 138 de las 15:05 horas del 23 de agosto; N° 192 de las 14:15 horas 1 del 06 de noviembre, ambas de 1991; N° 48 de las 14:10 horas del 29 de mayo de 1996 y N° 55 de las 14:30 horas del 4 de julio de 1997). Sin embargo, la aplicación del principio constitucional de reparación integral del daño no es irrestricto e ilimitado, ni tampoco, aplica de manera automática para todas las hipótesis en que sufra una lesión un administrado. Se requiere demostrar por un lado la existencia de un menoscabo patrimonial o lesión extrapatrimonial, y un nexo causal entre el daño alegado y la conducta (omisiva o activa) de la Administración. Al respecto, se ha indicado sobre el nexo causal que, “Establecida en la especie la anormalidad e ilicitud del comportamiento omisivo, resta por establecer si esa indolencia fue o no causa de la lesión reclamada, (…).
Lo anterior debido a que no basta la producción de un daño para que surja el deber de indemnizar, se requiere además que ese efecto haya sido generado por una conducta positiva u omisiva del Estado. Más simple, para imputar a la Administración la responsabilidad se requiere de un daño, una actividad o inactividad administrativa y un nexo causal entre ambos. Demostrado ese ligamen relacional, surge de inmediato el deber de reparación integral que se desprende del numeral 41 de la Constitución Política. En relación cabe señalar que, en la producción del daño, generalmente confluyen una serie de hechos y factores que en diversos grados lo han provocado. Dentro de ellos, es imperioso establecer cuáles de manera directa o indirecta han sido causa adecuada y eficiente del mal originado. Sobre la causa próxima, adecuada y eficiente, puede consultarse la sentencia de esta Sala no. 252-F-01, de las 16 horas 15 minutos del 28 de marzo del 2001.
En esa confluencia de elementos fácticos o jurídicos que rodean la situación dañosa, habrá necesidad de establecer la acción u omisión apta que provocó la consecuencia; desplazando aquéllas que no han tenido ninguna influencia en el resultado (causas extrañas), de las que, de no haber tenido lugar, hubiesen evitado el menoscabo”. (Sala Primera de la Corte Suprema de Justicia, Resolución N° 0074-F-2007 de las 10:15 horas del 02 de febrero de 2007). Pero como vimos, en primer lugar, en la especie la limitación que afecta a la propiedad de la actora no tiene efectos expropiatorios, por lo que no se logra derivar un incumplimiento de una obligación legal alguna, rompiendo el nexo de causalidad entre la conducta omisiva que reclama y los daños causados. En segundo lugar, la responsabilidad administrativa eventualmente, habiendo determinado una situación de que vaciara de contenido su derecho, lo cual se reitera no se da en la práctica, no tendría un efecto de indemnizatoria por responsabilidad, sino que los efectos de la expropiación son distintos.
En realidad “La actividad expropiatoria va encaminada a privar a un determinado sujeto total o parcialmente de un derecho o interés legítimo, mediante la correspondiente indemnización o pago del justiprecio, para la satisfacción de necesidades públicas. Va de suyo que se impone un sacrifico o singular al expropiado, trato de que no recibe el resto de los sujetos. (…) Es importante señalar que GIANNINI ha denominado ‘medidas ablatorias reales’ a aquella adoptadas por el poder público que buscan la consecución del interés público general. Dentro de las referidas medidas se citan la expropiación, las servidumbres, las ventas y permutas obligadas y, aquellas propias del derecho urbanístico, como puede ser imponer a un sujeto la obligación de no construir el inmueble de su propiedad, en tanto ha sido introducido dentro del patrimonio cultural. Por su parte, la responsabilidad de la administración supone que el ente público está obligado a indemnizar a los particulares, como reparación resarcitoria -ya no como justiprecio-, por el daño que causa su funcionamiento normal, anormal, legítimo o ilegítimo.
La indemnización es un mecanismo creado por la ley para compensar al sujeto por el daño que se le ha infringido por una determinada actuación u omisión administrativa. Ahora bien, debe tenerse presente que, el daño que se produce por responsabilidad administrativa extracontractual, no siempre se concreta en un beneficio social para la colectividad, como sucede con la expropiación que se acuerda por motivos de interés público”. (Rojas Morales (Iris Rocío). Derecho Urbanístico Costarricense. San José, Costa Rica, Editorial Investigaciones Jurídicas S.A., 2010, págs. 461 y 462). Por ende, no pueden equipararse ambas figuras, el justiprecio como su nombre lo indica es el pago que se recibe, es el valor económico de restitución por el despojo del bien que realiza la Administración para ser transformado o destinado a un fin público, en otras palabras, es el pago por la adquisición que se realiza, por lo que dicho monto debe ser razonable y proporcionado, debe ser equivalente, razonable y proporcionado para permitir a la persona física o jurídica poder resarcirse o compensar en el valor integral de la propiedad del bien expropiado.
Por lo que ambos términos, responsabilidad y expropiación, indemnización y justiprecio no resultan ser equivalentes o sinónimos, como erróneamente establece la parte actora, y consecuentemente debe rechazarse también este argumento. No está de más, señalar que, como tampoco la accionante esbozó una pretensión tendiente a que se determine la responsabilidad preeminentemente objetiva del Gobierno Local demandado, sino que la vinculó con la expropiación y su derecho indemnizatorio, al establecerse en el punto anterior que no aplica el procedimiento expropiatorio en la especie, no genera el derecho al pago alguno (pago del justiprecio), y éste no puede confundirse con la responsabilidad objetiva, se rechazan en todos sus extremos las pretensiones referidas a: “- Que se declare que la Municipalidad de Orotina no cumplió con el debido proceso administrativo de expropiación e indemnización a favor del propietario de la finca del Partido de Alajuela, Folio Real número 322557-000, por la introducción de una servidumbre de aguas en la citada finca. - Solicito se condene a la demandada al pago del área de terreno que conforma la servidumbre, a pagar el daño al remanente de la propiedad, al pago de la indexación que tengo derecho y a pagar los intereses de ley, mismos que se deben de calcular a partir de la toma de posesión del terreno, sea desde el 15 de enero del año 2004 hasta la fecha del efectivo pago del monto establecido; intereses que se calcularán sobre el monto de la indemnización y de acuerdo a la tasa de interés de los certificados de depósito a plazo a 6 meses del Banco Nacional de Costa Rica”.
No sin mencionar que, tampoco trajo a colación la accionante prueba que permitiera demostrar en qué consistió “el daño remanente” aludido en la segunda pretensión, y de dónde se derivaba, que era una obligación de su parte concretizarlo en qué consistían y de dónde se derivaban los daños, al tenor del numeral 58 inciso e) del CPCA, ni tampoco, logró vincular un nexo de causalidad entre alguna conducta (omisiva o activa) de la Municipalidad de Orotina en los términos aludidos, respecto mencionado como “al daño al remanente de la propiedad”, no comprendiéndose ni derivándose de la demanda y la prueba aportada, cuál es la afectación a ese remanente por la servidumbre impuesta por la ley. Al respecto, adviértase que, el tamaño de dicha servidumbre es de 121 m2 (Ver Hecho Probado N° 16) y el inmueble de la actora en su totalidad corresponde a 800 m2 (Ver Hechos Probados N° 1, 2 y 3), de donde se desprende que el porcentaje donde se encuentra ubicada la servidumbre no inutiliza el resto de la propiedad, es decir aún quedan 679 m2 libres donde puede disponer la realización del destino, que es la vivienda familiar.
De lo cual tampoco se demuestra que exista una afectación de la parte remanente, ni menos un daño, que tampoco ha sido probado por parte de la señora [Nombre 002], de hecho, conforme lo afirma el perito judicial, el espacio está siendo utilizado en vivienda por la propia actora, sin especificarse cómo la existencia en sí de la servidumbre le afecta al remanente de su dominio, sin perjuicio de lo que se dirá infra respecto de la funcionalidad de la servidumbre. Por lo que, tampoco se declara con lugar su pretensión de pagar el daño remanente a la propiedad resultante de esa servidumbre, corriendo la misma suerte la pretensión de indemnizar el monto de la indemnización y los intereses de ley, puesto que como se referenció, parten de la pretensión principal de que se procediera a determinar que debía expropiarse y pagarse lo correspondiente, la cual al ser rechazada, bajo el principio general de derecho que, lo accesorio corre la misma suerte del principal, también deben ser rechazados estos rubros de indexación y pago de intereses.
De lo cual, respecto a estas dos pretensiones se acoge la falta de derecho interpuesta por el Gobierno Local demandado. - 4. SOBRE LA PRETENSIÓN DE HACER “REPARACIÓN DE LA SERVIDUMBRE”: Por último, la señora [Nombre 002] estableció como pretensión que “(…) se le ordene a la Municipalidad de Orotina a reparar la servidumbre de aguas introducida en mi propiedad, darle continuidad a la canalización de la misma para que las aguas que en ella transitan sean sacadas de mi predio por el lindero norte de mi propiedad hasta darle una correcta y efectiva conducción a las aguas hasta un lugar seguro”. Al respecto, sin bien se ha titulado esta pretensión como “reparación de la servidumbre”, se considera que lo pretendido incluye labores de hacer por parte de la Corporación Municipal tendientes a que el agua escurra de forma encauzada y hasta su destino final, que sería el cuerpo de agua más cercano.
Por su parte, la Municipalidad en su defensa estipuló que: “(…) no tiene potestad para irrumpir en propiedad privada y muchos menos invertir pluviales y/o servidas constituye parte de las obligaciones del creador o desarrollador de un proyecto de fraccionamiento múltiple que, como en del asentamiento ‘El Vivero’, tuvo como objetivo para los lotes, y en particular el de la demandante, un uso urbano de vivienda”. Lo anterior, para efectos determinar que, está vedada en cuanto a invertir recursos públicos dentro de la propiedad de la actora. Más adelante, propiamente en la respuesta al Hecho Octavo de la demanda, señaló que: “(…) si la servidumbre (…) estuviere generando problemas de atascamiento, mala canalización o inundaciones, procede un análisis del problema a efetos de que las partes involucradas, en especial los propietarios afectados, con el apoyo de la Municipalidad de Orotina y otras instituciones competentes, puedan diagnosticar las causas y precisar soluciones, todo ello dentro del marco de legalidad atendible", pero indica no genera una obligación expropiatoria como lo afirma la accionante.
CRITERIO DEL TRIBUNAL: Sobre este el tema del funcionamiento de la servidumbre que está en la propiedad de la actora, este Órgano Jurisdiccional considera que no es un hecho controvertido que la alcantarilla y que el sistema pluvial del Asentamiento "El Vivero" esté presentando una serie de inconvenientes, siendo que el principal factor sería que, dada la forma en cómo fue diseñado por parte de un tercero que no fue la Municipalidad, ni consta que participara mediante actos de autorización o aprobación del diseño de la obra, se están generando una falta de capacidad del sistema pluvial, por razones que no fueron traídas a este proceso, pero que la misma Municipalidad ha reconocido, y fueron contestes los testigos funcionarios municipales en esa deficiencia del sistema pluvial. Principalmente se destaca el testimonio del señor Javier Alberto Umaña Durán quien reseñó ante la consulta de este Tribunal que está colapsadas las alcantarillas, dado que las canalizaciones son angostas, no pueden ser limpiadas por esa razón, y porque en el diseño del sitio las alcantarillas son muy pequeñas.
Pero también, el perito judicial González Portuguez, y el testigo ofrecido por la actora Luis Fernando Araya, en conjunto con José Pablo Rojas González y Javier Umaña Durán durante el Juicio Oral y Público señalaron que hay otros elementos que en la zona han obstruido el desfogue, quebradas las alcantarillas, y que si se presentan malos olores son producto de los mismos vecinos que depositan basura y ésta discurre por las áreas de canalizaciones, cunetas y alcantarillas. (Hecho Probado N° 17). Ahora bien, la disputa es ¿quién es la persona física o jurídica que debe invertir en subsanar esta situación? La Municipalidad refiere que es un tema privado, especialmente si están discurriendo aguas vertidas, y que el monto que asciende la reparación es muy elevado, que impediría atender otras obligaciones en el Cantón, de lo cual también el testimonio del referido funcionario público, Rojas González lo apuntó.
También se logra acreditar que la Municipalidad valoró en su momento modificar el desfogue de las aguas que pasa por la propiedad, opción que descartó, “(…) ya que se encuentra en el punto más bajo de la calle y es el punto de desagüe creado por el desarrollador de la urbanización, por lo que el desviar el recorrido actual de las aguas pluviales, que en este caso por gravedad, por la vía pública; vendría en representar costos enormes de alcantarillados pluviales, movimientos de tierra, expropiaciones y pérdida de la inversión realizada hasta el momento para el mejoramiento”. (…)”. (Hecho Probado N° 11, ver Oficio N° MO-DPDT-IV-177-2021 de fecha 24 de noviembre de 2021, visible a imágenes 183 y 184 del expediente judicial en formato electrónico y testimonios de los señores Juan Pablo González Calderón y Javier Alberto Umaña Durán, durante la Audiencia del Juicio Oral y Público). Sobre este aspecto en particular, dada la naturaleza de la servidumbre existe una responsabilidad compartida entre la titular del bien, que nace de las obligaciones legales dispuestas en el numeral 20 de la Ley General de Caminos Públicos respecto a realizar labores para mantener limpia y en perfecto estado la servidumbre fluvial, dentro de los rangos razonables y proporcionales, y la Municipalidad de Orotina, que ante la situación que se ha identificado por ella, en relación con los problemas de capacidad del sistema pluvial, y administradora de las vías públicas cantonales, así dispuesto por los numerales 1 y 2 de la Ley General de Caminos, y del sistema pluvial como un todo, debe intervenir para buscar una solución pronta a esta situación.
La tesis municipal parte de una premisa falsa, y es el hecho de considerar que, al momento en que el sistema pluvial ingresa en propiedad privada, se privatiza éste, lo cual no es cierto. Se reitera, conforme la prueba obrante en autos, en la zona en discusión existe una vía pública, y dicho camino cuenta con un sistema pluvial que discurre sobre el terreno de la actora, a través de infraestructura que constituye una servidumbre a favor del sistema vial administrado por el propio municipio, es decir, el municipio en tanto administrador del señalado sistema vial, es el competente para realizar las acciones necesarias para garantizar el óptimo y efectivo funcionamiento del camino público a su cargo, sin demérito de las obligaciones que se establecen en el artículo 20 de la Ley General de Caminos Públicos a cargo de la actora. Debe recordarse que, al Gobierno Local, conforme al numeral 169 constitucional se le atribuyeron las competencias para administrar los intereses y servicios locales en cada cantón, administración que implica gestionar recursos tanto materiales como humanos, y que no sólo se constriñe, como pareciera inferirse de su postura, al realizar una inspección y determinar que dado el volumen de los recursos que debe invertirse y que fue un tercero quien lo diseñó, no puede ejercer sus competencias.
El que un tercero haya efectuado obras con o sin cumplir con el bloque de legalidad, no exime del rol de administración municipal, lo cierto es que, el quehacer municipal descansa en una serie de labores políticas, de planificación, presupuestarias, recreativas, educativas y de prestación de servicios en general todo en favor de promover el desarrollo integral de las personas que habitan dentro de su jurisdicción. Pero también cuenta con poderes de policía para ejercer un orden dentro de su jurisdicción, de la mano por supuesto con las competencias que disponen las instituciones públicas a nivel nacional. Sin embargo, existe constitucionalmente un rol muy importante de la Municipalidad en la administración de esos intereses cantonales, el cual tiene como origen, la necesidad de descentralizar al Estado, y dotar a nivel de los cantones, de la posibilidad de que éstos, dada su cercanía con la población, puedan velar por los intereses públicos y objetivos, en pro del bienestar y el progreso de lo local.
Así lo ha establecido la Sala Constitucional de la Corte Suprema de Justicia, al apuntar que: “(…) conforme lo establece el artículo 169 de la Constitución Política y el Código Municipal, corresponde a las municipalidades la administración de los servicios e intereses locales, con el fin de promover el desarrollo integral de los cantones en armonía con el desarrollo nacional. En consecuencia, la Municipalidad debe establecer una política integral de planeamiento urbano de acuerdo con la ley respectiva, que persiga el desarrollo eficiente y armónico de los centros urbanos y que garantice -al menos- eficientes servicios de electrificación y de comunicación; buenos sistemas de provisión de agua potable y evacuación de aguas servidas, adecuados sistemas de acueductos y alcantarillado, sistemas de iluminación y ornato de las ciudades; servicios de construcción, reparación y limpieza de calles y otras vías públicas; en general planes concretos y prácticos para hacer confortable y segura la vida de la población”.
(Ver Sala Constitucional de la Corte Suprema de Justicia. Resolución Nº 12886 – 2011 de las 12:44 horas de 23 de Setiembre del 2011). (El resaltado no corresponde al original). Adviértase que, expresamente el Tribunal Constitucional le reconoce las facultades de administración de los sistemas de alcantarillado y pluviales del cantón a la Municipalidad, y por supuesto que tiene un sentido lógico, por cuanto, estos se encuentran interconectados en la práctica, no están aislados, y cada uno de los diseños que se edifiquen para desfogar aguas de cada uno de los habitantes del cantón, o personas que participan económicamente de éste, inciden sobre todo el cantón. Por lo que, no se comparte el criterio del Ayuntamiento de que es un problema privado o ajeno a sus competencias, sino todo lo contrario, además de recibir la denuncia interpuesta por la actora, en fecha 14 de enero de 2021 donde se exponía la problemática, y de darle curso en fecha 03 de febrero de 2021 (Ver Hechos probados N° 9 y 10), la Corporación Municipal debió de establecer una estrategia de atención de la situación, no es que se le exija que debe realizarlo únicamente con recursos propios, sino que tiene el deber de ser eficaz y eficiente en la prestación del servicio público (artículo 4 de la Ley General de la Administración Pública), y con los instrumentos que están dispuestos en el ordenamiento jurídico planificar para resolver la situación del Asentamiento "El Vivero", pero no lo hizo.
Sí es cierto que ha estado realizando algunas mejoras en la superficie de rodamiento, así como en el alcantarillado pluvial (Ver Hechos Probados N° 11 y 12), pero esas labores no se demostraron que fueran efectivas para mitigar los efectos sobre la propiedad de la actora. En su contestación de la demanda la representación del Ayuntamiento indica que, por ejemplo, si hay problema con los vertidos debe la parte actora resolverlo, y al momento de darle curso a su denuncia también se le respondió en la misma línea (Ver Hecho Probado N° 10), pero se echa de menos, que teniendo clara esa situación, no haya puesto en conocimiento al Ministerio de Salud, y coordinado con éste la atención de dicha situación. El dar curso a una denuncia, no significa resolver la situación, y está en deber de realizarlo, dado que es a la Municipalidad a quien le corresponde coordinar y administrar los sistemas pluviales del cantón, y atender las necesidades locales, máxime cuando se trata de salud (vertidos).
Por lo que, dentro del ejercicio de planificación urbana, y el otorgamiento de las licencias (inclusive de desfogue pluvial) que son parte de esta competencia política de planificación urbana anteriormente referida, lleva inmersa esa potestad de policía y de verificación de que las actividades económicas, agropecuarias, comerciales, urbanísticas, turísticas, recreativos, productivos, educativos, culturales y demás, se efectúen dentro del bloque de juridicidad, y en armonía con el ambiente, de lo cual se deriva del precepto 50 de la Norma Fundamental, y a nivel legal se encuentra plasmado en el numeral 28 de la Ley Orgánica del Ambiente, obligación de administración de los intereses del cantón que se mantiene, aún cuando sea un tercero que omitiendo las formalidades y requisitos construyó o edificó una infraestructura en su circunscripción territorial, por lo que, debe involucrarse en buscar una solución integral a la situación.
Dentro de este marco constitucional es como se debe entender el artículo tercero del Código Municipal, en donde se regula que, “El gobierno y la administración de los intereses y servicios cantonales estarán a cargo del gobierno municipal” y el numeral primero de la Ley de Construcciones, al postular que: “Las Municipalidades de la República son las encargadas de que las ciudades y demás poblaciones reúnan las condiciones necesarias de seguridad, salubridad, comodidad, y belleza en sus vías públicas y en los edificios y construcciones que en terrenos de las mismas se levanten sin perjuicio de las facultades que las leyes conceden en estas materias a otros órganos administrativos”. Adviértase que la normativa legal no excluye el ejercicio de las potestades municipales sobre las propiedades privadas, es parte de sus funciones de regulación de lo urbano, establecer condiciones para que el desarrollo urbano sea equilibrado, lo cual también incluye que los desarrollos constructivos deben ser armónicos entre todo el conglomerado del cantón, tanto el ámbito lo rural y urbano, público y privado por lo que no es correcto, como lo apuntó en varias oportunidades por parte de la Municipalidad que no puede invertir recursos en resolver un tema dentro de una propiedad, por cuanto la situación de la falta de capacidad del sistema pluvial no solo afecta a la propiedad de la actora, sino que en el futuro ante la crecida de las lluvias o la construcción de otras edificaciones en el lugar, podría generar que la situación se agrave.
Ahora bien, entiende este Tribunal las diferentes dificultades, especialmente en materia de recursos que enfrentan los Gobiernos Locales, y las altas exigencias de las poblaciones actuales, donde cada vez más requieren de mayores prestaciones de las Municipalidades, exigiendo espacios de alta participación ciudadana, transparencia, y rendición de cuentas, pero a la vez, también ante el mayor desarrollo urbanístico, y el crecimiento de las poblaciones y ciudades llevan grandes desafíos para balancear las potestades municipales con la propiedad privada y la libertad de comercio. Precisamente, en materia municipal, a nivel constitucional desde los orígenes de la Sala Constitucional se le ha reconocido que las Municipalidades al momento de ejercer sus competencias en administrar de forma directa los intereses del cantón, pueden o incluso deben realizarlo mediante una coordinación estrecha con las diferentes entidades públicas, relaciones de coordinación y cooperación que permitan cumplir con los objetivos constitucionales y legales que le han sido conferidas para ser satisfechas.
De esta forma, la Sala Constitucional de la Corte Suprema de Justicia esbozó: “III.- CONCEPTOS GENERALES SOBRE EL RÉGIMEN MUNICIPAL. En Costa Rica el régimen municipal es una modalidad de la descentralización territorial, según se desprende del párrafo primero del artículo 168 constitucional. Se define, principalmente, en los artículos 169 y 170 de la Constitución Política que señalan, en lo que interesa, que la ‘administración de los intereses y servicios locales estará a cargo del Gobierno Municipal formado por un cuerpo deliberante de elección popular y de un funcionario ejecutivo que designa la ley’ (hoy día Alcalde Municipal); es un ‘sistema corporativo que goza de autonomía y de recursos económicos propios (competencia presupuestaria)’. De esta enunciación de los principales rasgos jurídicos de la institución municipal, resulta absolutamente claro que se derivan ciertos elementos, a saber: la existencia de una jurisdicción territorial para atender los intereses y servicios del nivel local; la constitución de una población fincada en lazos de vecindad, de manera que todo habitante del Cantón es munícipe; el gobierno formado por dos órganos diferenciados (Concejo y Alcalde) con funciones y relaciones entre ellos definidas; la naturaleza corporativa de la institución; garantía constitucional de independencia (autonomía); y la materia objeto de su administración, que está formada por todo aquello que sea o constituya ‘interés y servicio local’.
Desde el punto de vista político, las municipalidades son gobiernos representativos con competencia sobre un determinado territorio (cantón), con personalidad jurídica propia y potestades públicas frente a sus munícipes (habitantes del cantón); operan de manera descentralizada frente al Gobierno de la República, y gozan de autonomía constitucionalmente garantizada y reforzada que se manifiesta en materia política, al determinar sus propias metas y los medios normativos y administrativos en cumplimiento de todo tipo de servicio público para la satisfacción del bien común en su comunidad. (...) Todo esto implica, necesariamente, que para poder definir correctamente la conformación del Estado Costarricense, debe existir un ensamble exacto en la suma de los Gobiernos Municipales en su conjunto e individualmente, en orden a las relaciones y funcionamiento coordinado con el Gobierno de la República, para evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, y la confusión de derechos y obligaciones entre las diversas partes involucradas”.
(Sala Constitucional, Resolución Nº 05445-1999 de las 14:30 horas de 14 de Julio del 1999). Estas potestades de coordinación que están expresamente establecidas en el precepto 6 del Código Municipal donde se estipula que: “La municipalidad y los demás órganos y entes de la Administración Pública deberán coordinar sus acciones. Para tal efecto deberán comunicar, con la debida anticipación, las obras que proyecten ejecutar”. A estos mecanismos de coordinación y cooperación interinstitucional podría haberse valido el Ayuntamiento, pero no consta en los autos que lo haya hecho. Adviértase que, la necesidad de coordinación del Gobierno Local con las otras instituciones con competencia local, regional o nacional está literalmente prevista en el numeral sexto del Código Municipal en donde se establece que: “Artículo 6. - La municipalidad y los demás órganos y entes de la Administración Pública deberán coordinar sus acciones.
Para tal efecto deberán comunicar, con la debida anticipación, las obras que proyecten ejecutar”. Pudiendo incluso acudir a la figura de los convenios interinstitucionales, a fin de cumplir con sus mandatos de Ley, al tenor del artículo 7 del Código Municipal, que regula: “Mediante convenio con otras municipalidades o con el ente u órgano público competente, la municipalidad podrá llevar a cabo, conjunta o individualmente, servicios u obras en su cantón o en su región territorial. (Así reformado por el artículo 17 de la ley General de transferencia de competencias del Poder Ejecutivo a las Municipalidades, N° 8801 del 28 de abril de 2010)”. Dichos mecanismos de coordinación y cooperación han sido reconocidos por parte de la Sala Constitucional, estableciéndose su conformidad con el bloque constitucional, al establecer que: “X.- DE LA OBLIGACIÓN DE COORDINACIÓN CON LAS INSTITUCIONES ESTATALES.
Varias de las disposiciones que se cuestionan en esta inconstitucionalidad -artículos 5, 10 y 186 del Código Municipal, 2 de la Ley de Tránsito por Vías Públicas Terrestres, 2 de la Ley General de Caminos Públicos, 9 y 10 de la Ley de Planificación Nacional, 26 y 27 de la Ley General de la Administración Pública y 4, 10, 16, 17 y 18 de la Ley de Planificación Urbana-, se refieren a la obligación de coordinación que debe existir entre los gobiernos locales, las instituciones descentralizadas y el Poder Ejecutivo, para llevar a cabo las funciones que le han sido encomendadas, lo que debe ser analizado a partir de la naturaleza misma de la autonomía municipal. Es en virtud de lo dispuesto en el artículo 170 constitucional, que las municipalidades (entes corporativos locales) gozan de autonomía funcional, administrativa y financiera en la administración de los intereses y servicios locales (artículo 169 de la Constitución Política), lo que ha sido reconocido en la jurisprudencia constitucional en forma reiterada (en este sentido, entre otras ver sentencias número 01119-90, 02934-93, 00140-94, 03494-94, 06000-94, 03930-95, 02231-96, y 06469-97.
(…) Definida la competencia material de la municipalidad en una circunscripción territorial determinada, queda claro que habrá cometidos que por su naturaleza son exclusivamente municipales, a la par de otros que pueden ser reputados nacionales o estatales; por ello es esencial definir la forma de coparticipación de atribuciones que resulta inevitable, puesto que la capacidad pública de las municipalidades es local, y la del Estado y los demás entes, nacional; de donde resulta que el territorio municipal es simultáneamente estatal e institucional, en la medida en que lo exijan las circunstancias. Es decir, las municipalidades pueden compartir sus competencias con la Administración Pública en general, relación que debe desenvolverse en los términos como está definida en la ley (artículo 5 del Código Municipal anterior, artículo 7 del nuevo Código), que establece la obligación de ‘coordinación’ entre la municipalidades y las instituciones públicas que concurran en el desempeño de sus competencias, para evitar duplicaciones de esfuerzos y contradicciones, sobre todo, porque sólo la coordinación voluntaria es compatible con la autonomía municipal por ser su expresión.
En otros términos, la municipalidad está llamada a entrar en relaciones de cooperación con otros entes públicos, y viceversa, dado el carácter concurrente o coincidente -en muchos casos-, de intereses en torno a un asunto concreto. En la doctrina, la coordinación es definida a partir de la existencia de varios centros independientes de acción, cada uno con cometidos y poderes de decisión propios, y eventualmente discrepantes; pese a ello, debe existir una comunidad de fines por materia, pero por concurrencia, en cuanto sea común el objeto receptor de los resultados finales de la actividad y de los actos de cada uno. De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes.
Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible ‘concierto’ interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros”. (Resaltado es de autoría propia). (Sala Constitucional, Resolución Nº 05445 – 1999 de las 14:30 horas de 14 de Julio del 1999, citada). De esta manera, también, la Municipalidad está obligada a acudir a diferentes mecanismos de planificación de obra pública, como también dentro de esas competencias constitucionales y legales, se encuentra la fijación de la política municipal, por parte del Consejo Municipal, en donde se establecen las prioridades del cantón para promover, lo que se ha indicado en líneas anteriores, el desarrollo integral y prospectivo del cantón, al establecerse en el ordinal 13 de dicho Código Municipal que, le corresponde al referido órgano colegiado municipal “a) Fijar la política y las prioridades de desarrollo del municipio, conforme al programa de gobierno inscrito por el alcalde municipal para el período por el cual fue elegido y mediante la participación de los vecinos”., (…) “d) Organizar, mediante reglamento, la prestación de los servicios municipales”.
“ l) Aprobar el Plan de Desarrollo Municipal y el Plan Anual Operativo que elabore la persona titular de la alcaldía, con base en su programa de gobierno e incorporando en él la diversidad de necesidades e intereses de la población para promover la igualdad y la equidad de género”, entre otras competencias, de lo que se infiere que el Gobierno Municipal cuenta con amplias atribuciones para definir la política, las normas reglamentarias y lineamientos que deberán seguirse para la administración de los sistemas pluviales, lo cual incluye por supuesto la planificación y el control del ordenamiento urbano, y buscar el equilibrio de la satisfacción del interés público y necesidades de los habitantes de la zona. Lo anterior, al tenor del numeral 113 de la Ley General de la Administración Pública, que postula que: “1. El servidor público deberá desempeñar sus funciones de modo que satisfagan primordialmente el interés público, el cual será considerado como la expresión de los intereses individuales coincidentes de los administrados. 2.
El interés público prevalecerá sobre el interés de la Administración Pública cuando pueda estar en conflicto. 3. En la apreciación del interés público se tendrá en cuenta, en primer lugar, los valores de seguridad jurídica y justicia para la comunidad y el individuo, a los que no puede en ningún caso anteponerse la mera conveniencia”. Dentro de esa satisfacción del interés público para este Tribunal incluye una gestión eficiente y efectiva de los sistemas pluviales que están dentro de su circunscripción territorial, y de buscar una solución integral a la situación que está aconteciendo en el Asentamiento "El Vivero", y emprender conjuntamente con otras entidades, y sin desmérito de las obligaciones de la actora, a la realización de las obras que deba efectuarse para su resolución pronta. En este sentido, debe aclararse que, de lo indicado por este Tribunal no puede deducirse que la señora Venegas Montero no deba cumplir con sus obligaciones legales de realizar el mantenimiento al desfogue pluvial que está en su propiedad, y a retirar escombros y basura que esté obstaculizando la alcantarilla, no es ese el sentido de la posición de este Órgano Jurisdiccional, sino del hecho que, la misma Municipalidad ha identificado un problema que debe ser resuelto respecto a la capacidad del sistema pluvial (entre otros, que eventualmente requieran ser diagnosticados) y es por ello que, debe realizarse labores dirigidas a ir mitigar los efectos de las acciones que anteriormente se han efectuado sin autorización ni participación municipal, gestionando con las entidades públicas correspondientes para buscar invertir en esa zona y resolver con una planificación prospectiva los defectos o situaciones que se están presentando actualmente en el sistema pluvial del Asentamiento "El Vivero".
Todo en respeto a la discrecionalidad técnica y autonomía municipal que le asiste a la Corporación Municipal, y dentro de las competencias constitucionalmente previstas de administración de lo local que le competen, y de coordinación con las entidades públicas y privadas que considere oportunas involucrar. Y bajo esa óptica, se acoge parcialmente la pretensión de la actora de que se busque e implemente una solución del problema de las aguas pluviales de dicho Asentamiento "El Vivero" y sus implicaciones sobre su propiedad, acciones que deberán realizarse de forma razonable y proporcionada, ajustas a la ciencia y a la técnica y previa coordinación con las entidades públicas que correspondan. -
Según lo que se ha expuesto en líneas anteriores, y no se indica nuevamente para evitar ser reiterativos, derivado de la omisión de la expropiación de la franja donde se encuentra la servidumbre, solicita que sea indemnizado, así como también sobre los daños "del remanente". Para este tema aplica lo apuntado por ambas partes según las posiciones que fueron transcritas en los primeros considerandos de esta Resolución (tercero y cuarto), así como lo ya discutido en el considerando titulado "Caso Concreto". CRITERIO DEL TRIBUNAL. Según se había señalado en el considerando anterior, del artículo 41 de la Constitución Política, en relación con los numerales constitucionales 9, 11 y 33, existe un régimen de responsabilidad preeminentemente objetiva del Estado, del cual parte de la existencia de tres supuestos: la concurrencia del daño (resarcible, es decir, que genere una lesión patrimonial o extrapatrimonial a la persona), una conducta (omisiva o activa) de la Administración (en este caso sería la Municipalidad de Orotina) y un nexo causal entre ambos.
Nexo causal que se rompería con la existencia de algún eximente de responsabilidad como lo sería “fuerza mayor, culpa de la víctima o hecho de un tercero”, al tenor de lo dispuesto por el numeral 190 inciso 1) de la Ley General de la Administración Pública. Al respecto, como se ha apuntado en líneas anteriores, la actora demanda el pago de daño del terreno remanente más de 679 m2 y de la imposición de una servidumbre, no obstante conforme al análisis efectuado de las pretensiones principales que fundamentaron la tesis de la demanda de la actora, no se determinó la existencia de una omisión por parte de la Municipalidad de Orotina, ni tampoco se esbozó alguna pretensión tendiente a declarar la responsabilidad objetiva de dicho Gobierno Local por otros daños o conductas, sino como se referenció pendía de que se otorga con lugar la necesidad de llevar a cabo un procedimiento de expropiación, pretensión que fue declarada sin lugar.
En virtud de lo anterior, al no acreditarse un nexo de causalidad adecuada entre la conducta del Gobierno Local demandado y los daños que están siendo reclamados por la parte actora, consecuentemente no pueden ser acogidas sus pretensiones de pago o indemnización. Al respecto, la Sala Primera de la Corte Suprema de Justicia en la Resolución N° 112-1992 de las 14:15 horas de fecha 15 de julio de 1992 (posición que se ha sido reiterada a la fecha y que se comparte por esta Cámara de Juzgadores), esbozó que: “El daño constituye uno de los presupuestos de la responsabilidad civil extracontractual, por cuanto el deber de resarcir solamente se configura si ha mediado un hecho ilícito dañoso que lesione un interés jurídicamente relevante, susceptible de ser tutelado por el ordenamiento jurídico. El daño, en sentido jurídico, constituye todo menoscabo, pérdida o detrimento de la esfera jurídica patrimonial o extrapatrimonial de la persona (damnificado), el cual provoca la privación de un bien jurídico, respecto del cual era objetivamente esperable su conservación de no haber acaecido el hecho dañoso.
Bajo esta tesitura, no hay responsabilidad civil si no media daño, así como no existe daño si no hay damnificado. Por otra parte, sólo es daño indemnizable el que se llega a probar (realidad o existencia), siendo ello una cuestión de hecho reservada al prudente arbitrio del juzgador. En suma, el daño constituye la brecha perjudicial para la víctima, resultante de confrontar la situación anterior al hecho ilícito con la posterior al mismo. (...)” (Lo resaltado es autoría propia). De ahí que se colija que, sin la existencia de una responsabilidad que pueda ser imputable a la Municipalidad de Orotina no puede derivarse un derecho indemnizatorio. Y como bien se extrae de la referida resolución judicial, y de la jurisprudencia que ha sido desarrollada a lo largo de esta exposición, si no se demuestra una causalidad adecuada, no puede derivarse un derecho a que se le reconozcan los daños que aduce, en el tanto, se reitera, tampoco logró acreditar la existencia del "daño al remanente" que adujo, presupuesto necesario para que sea fructífera su pretensión de indemnización, lo que deviene en rechazar las pretensiones de pago de daños y consecuentemente también las pretensiones accesorias correspondientes al pago de los intereses e indexación sobre las sumas que hiberan sido reconocidas en sentencia, que parten de la existencia de una indemnización, sustrato o fundamento que al no declararse sin lugar, corre la misma suerte que el principal (su rechazo).
Por lo anterior, respecto a las pretensiones indemnizatorios se acoge la defensa de derecho presentada con su contestación la representación de la Municipalidad de Orotina y se declara sin lugar la demanda incoada, respecto a las pretensiones que corresponderían a los párrafos 2 y 3 referidas al pago de la franja donde se encuentra la servidumbre, y el daño remanente, los intereses e indexación sobre esas sumas. -
La representación de la Municipalidad de Orotina, en la contestación de la demanda, interpuso las excepciones de falta de legitimación pasiva y falta de derecho. Así las cosas, por la forma en cómo se ha resuelto el presente asunto, en cuanto a que esta Cámara Colegiada luego del análisis efectuado de los autos y de la prueba que fue ofrecida por las partes y admitida en el momento procesal oportuno, acoge parcialmente las pretensiones únicamente en cuanto a determinar la existencia de una servidumbre en la propiedad de la actora, servidumbre que fue calificada como legal (artículo 20 de la Ley General de Caminos Públicos) y la conducta de hacer requerida por la accionante, en el sentido de que se ordene a la Municipalidad de Orotina a solventar el problema del desfogue pluvial, consecuentemente conlleva a declarar parcialmente la demanda interpuesta por la señora [Nombre 002], con sustento en los argumentos de hecho y de derecho, desarrollados en la presente Resolución.
De suerte que, por ende, se acoge parcialmente la excepción de falta de legitimación pasiva por cuanto no se logró determinar que la Municipalidad fuera la persona jurídica que instaló o construyó la servidumbre que afecta la finca folio real N° 322557-000 del Partido de Alajuela titular de la actora, y se acoge parcialmente también la falta de derecho, en lo que respecta a que se declarara que la Corporación Municipal fuera la que construyó e instaló la servidumbre; en lo concerniente a la omisión del Gobierno Local de realizar el procedimiento expropiatorio del terreno afecto y por ende, que procediera con el pago respectivo de la franja de terreno donde está instala la servidumbre ut supra, y del daño remanente alegado, con los consecuentes intereses e indexación reclamados sobre las sumas que hubieran sido determinadas, con sustento en lo anteriormente establecido en el fallo de marras. -
Respecto a las costas de este proceso, de conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena sólo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, considera esta Cámara que, en virtud de estar en presencia de un vencimiento recíproco de lo discutido en la presente litis, derivando por ello que, en la especie, tanto la parte actora como demandada tenían motivos suficientes para litigar, se debe falla la presente sentencia sin especial condenatoria en costas. -
POR TANTO
Con base en los fundamentos de hecho y derechos expuestos, se acoge parcialmente las excepciones de falta de legitimación pasiva y falta de derecho interpuesta por la parte de la Municipalidad demandada, y consecuentemente, SE DECLARA PARCIALMENTE CON LUGAR la demanda interpuesta por la señora [Nombre 002] en contra de la MUNICIPALIDAD DE OROTINA, entendiéndose denegada en lo no expresamente reconocido. Se ordena a la MUNICIPALIDAD DE OROTINA a implementar, ejecutar, coordinar y/o exigir a quien corresponda la realización de acciones concretas, a fin de identificar y solventar los problemas que se están presentando en el sistema de aguas pluviales del Asentamiento “El Vivero”, y que permitan resolver en definitiva los problemas que afectan a la propiedad de la actora. Dichas acciones, al tenor de lo establecido en el numeral 157 del Código Procesal Contencioso Administrativo, deberán ser efectuadas dentro de un plazo que no supere tres (3) meses, contado a partir del día siguiente a la notificación de la presente sentencia, en el entendido de que, el juez de ejecución aprobará y fiscalizará las acciones para el cumplimiento efectivo de la presente sentencia.
Se resuelve sin especial condenatoria en costas, en virtud del vencimiento recíproco de ambas partes.
