MUNICIPALIDAD DE PUNTARENAS No. N° 2024000947 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SECCIÓN TERCERA. SAN JOSÉ, GOICOECHEA, at thirteen hours and eleven minutes on February sixteenth, two thousand twenty-four.- Proceeding on the merits (proceso de conocimiento), conducted under the oral-trial procedure (trámite de juicio oral), instituted by Mr. JOSÉ ENRIQUE CRUZ ZELEDÓN, holder of identity card number 6-184-178, against the MUNICIPALIDAD DE PUNTARENAS, represented by its special judicial attorney-in-fact (apoderada especial judicial), Licenciada ADRIANA NÚÑEZ QUINTANA, holder of identity card number 1-973-118 and professional license number 16103. Licenciado RAFAEL BROOCKS MC KENZIE, holder of identity card number 6-162-827 and professional license number 8041, participates as special judicial attorney-in-fact for the plaintiff.

WHEREAS (CONSIDERANDO)

I.PRELIMINARY MATTERS.- A) This decision is issued in accordance with the formalities established in Ley N° 9342, Código Procesal Civil (hereinafter CPC), and the Reglamento sobre Expediente Judicial Electrónico ante el Poder Judicial (hereinafter REJEPJ), approved by Corte Plena in Article XXXI of session N° 22-13, held on May 20, 2013; B) The judgment is adopted unanimously following the corresponding deliberation, with the decision drafted by the reporting judge, Judge Rodríguez Cubero, and with the concurring vote and opinion of Judges Chaves Torres and Perera León.

II.PROCEDURAL BACKGROUND.- The following is an account of the procedural history (iter procesal): 1.- The relief sought (pretensiones) by the plaintiff, according to the complaint filed on March 04, 2020, and the adjustments made at the preliminary hearing held on May twentieth, two thousand twenty-two, is that the judgment establish: “...1. That this civil action against the Public Treasury for adverse possession (demanda civil de hacienda de usucapión) be granted and, consequently, that it be declared that the plaintiff has acquired by adverse possession the land to which this dispute pertains and, consequently, should the defendant prove that it is the owner of said land, that the title be declared null because the plaintiff has acquired it by adverse possession, and that the customary writs be issued to the Registro Nacional so that it may register said land in the plaintiff’s name, which will, of course, entail registration of the survey plat submitted with this action. /2.

Should the foregoing principal claim be denied, that the defendant be ordered to pay for the improvements made by the plaintiff to the aforementioned land, the care he has provided to it, and the increase in value that his possession, care, and improvements have produced in the land in question, with a right of retention (derecho de retención) until actual payment thereof, the amount to be determined during enforcement of the judgment (ejecución de sentencia) as assessed by an expert at that time. /3. Should the defendant oppose the action without basis, recklessly, and/or improperly, that it be ordered to pay both categories of costs (ambas costas) of this action...” (see images 01 through 08 and 111 through 114 of the digital court case file scanned into a single PDF file and the digital recording of the preliminary hearing).

  1. 2By an order issued at twelve hours and fifty-three minutes on April two, two thousand twenty, this Court served the complaint on the Municipalidad de Puntarenas (see images 21 through 23 of the digital court case file scanned into a single PDF file).
  2. 3In a pleading dated July 27, 2020, counsel for the Municipalidad de Puntarenas denied the allegations of the complaint, requested that it be dismissed, and raised the defenses (excepciones) of lack of standing as plaintiff (falta de legitimación ad causam activa) and failure to establish a legal right (falta de derecho), and requested that the plaintiff be ordered to pay both categories of procedural costs, together with the corresponding interest (see images 31 through 35 of the digital court case file scanned into a single PDF file).
  3. 4By an order issued at nine hours and twenty-one minutes on August three, two thousand twenty, this Court deemed the complaint timely and properly answered by the Municipalidad de Puntarenas and granted the plaintiff 3 business days to respond to the defenses raised (see image 37 of the court case file).
  4. 5The preliminary hearing provided for in section 90 of the CPCA was held beginning at nine hours and nineteen minutes on May twentieth, two thousand twenty-two, during which its various stages were conducted. The claims were established in the form already defined in item one of this section. Facts 2, 3, 4, and 5 of the complaint were identified as disputed facts, and the relevant documentary evidence (prueba documental) of both parties was admitted. The plaintiff was permitted to present the testimony of Miguel Jiménez Cordero and Róger Cruz Zeledón, and the defendant was permitted to present the testimony of Luis Diego León Quirós as an expert witness (testigo-perito). Those proceedings were recorded in the corresponding electronic system and are contained in the associated-documents folder of the virtual case file (see images 112 through 114 of the digital court case file scanned into a single PDF file and the digital recording of the preliminary hearing).
  5. 6The trial hearing was held on January twenty-nine, two thousand twenty-four, and was conducted by Collegiate Court number three, composed of Judges Francisco José Chaves Torres, Vernor Perera León, and Lindsay Rodríguez Cubero, the latter serving as reporting judge, with the assistance of judicial technician Diana Carolina Mejía Aguilar. The plaintiff and defendant were present, together with their legal representatives. Testimony was received from Miguel Jiménez Cordero, Roger Cruz Zeledón, and Luis Diego León Quirós. The parties subsequently presented closing arguments, after which the Court informed them that, pursuant to Article 111 of the CPCA, judgment would be rendered within the following fifteen business days and would thereafter be served through the designated means and within the time limits established by the Ley de Notificaciones Judiciales for such purposes; the supplementary hearing was then closed (see images 125 through 128 of the digital court case file scanned into a single PDF file and the digital recording of the public trial).
  6. 7There are no defects or omissions that would render the proceedings conducted in this matter procedurally null.

III.SUBJECT MATTER OF THE PROCEEDING.- The principal claim asserted by the plaintiff in this contentious-administrative proceeding is the first claim, which is declaratory in nature and requests a determination that Mr. Cruz Zeledón acquired by adverse possession the land described in the unregistered survey plat dated January 2020, with an area of 1207 square meters, which adjoins a property owned by him to the south, as of July 03, 1998. He states that on that date he acquired original possession of the property in question and exercised it quietly, openly, peacefully, continuously, and under a claim of ownership. Such possession consisted of fencing the land, annexing it to the land he owns, growing ornamental plants, fruit trees, and grass, maintaining it, and generally caring for it, exercising all attributes of ownership for 22 years without interference by any natural or legal person.

He states that it was not until January 2020, when he sought to register the indicated survey plat, that the Municipalidad informed him that the land was under the administration of the defendant and that he could not obtain title to the land through possessory-information proceedings (información posesoria). Additionally, he requests that, if he cannot be declared the owner of the land, he be compensated for the improvements he made to it, in an amount to be determined during enforcement of the judgment. Finally, he requested that the State be ordered to pay costs. Counsel for the Municipalidad de Puntarenas opposed the action and raised the defenses of lack of standing as plaintiff and failure to establish a legal right. Accordingly, it must now be determined whether the plaintiff is legally entitled to the relief requested.

IV. PROVEN FACTS

Of importance to the issuance of this decision, the following facts are deemed duly established under the rules of reasoned evaluation of evidence (sana crítica racional), either because they arise from the body of evidence submitted and admitted in this proceeding or because the parties have accepted them.

  • 1)On July 03, 1998, Mr. Cruz Zeledón acquired the property registered in the Puntarenas registry district, volume one thousand five hundred eleven, folio four hundred forty-five, number ten thousand seven hundred forty-seven, entry three, measuring one thousand one hundred sixty-four square meters and thirty-eight square decimeters, with the following boundaries: to the north, a public street; to the south, a highway; to the east, lot 49; and to the west, Lot 51 (see deed number four hundred thirty-seven executed by notary public Marco Aurelio Zúñiga Angulo, dated July three, one thousand nine hundred ninety-eight, appearing at images 15 through 16 of the court case file scanned into a single PDF file, and the search conducted today in the Registro Nacional’s digital search system).
  • 2)The land described in the unregistered survey plat prepared in January 2020 by surveying professional Wilbert Acuña Acuña, with an area of 1207 square meters, is located within the excess areas (demasías) of lands sold by the Instituto Costarricense de Turismo in the maritime-terrestrial strip (franja marítimo terrestre) between Chacarita and the mouth of the río Barranca (see the testimony of expert witness León Quirós in the digital recording of the public trial and the survey plat visible at image 19 of the court case file scanned into a single PDF file).
  • 3)Since July 03, 1998, Mr. Cruz Zeledón has taken actions to annex the land at issue in this proceeding to the property registered in the Puntarenas registry district, volume one thousand five hundred eleven, folio four hundred forty-five, number ten thousand seven hundred forty-seven, entry three (see the statements of witnesses Miguel Jiménez Cordero and Róger Cruz Zeledón in the digital recording of the public trial).

V.UNPROVEN FACTS.- Of importance to the disposition of this action, the following is deemed unproven because no supporting evidence appears in the case file:

  • 1)That the claimant possesses an enabling administrative title (título administrativo habilitante) or any legal status granting him the legal possibility of benefiting from exclusive use (uso privativo) of the strip of land over which he claims to exercise possessory acts (actos posesorios), identified in the unregistered survey plat prepared in January 2020 by surveying professional Wilbert Acuña Acuña, with an area of 1207 square meters (there is no evidence regarding this matter).
  • 2)That the plaintiff made improvements to the strip of land over which he claims to exercise possessory acts, identified in the unregistered survey plat prepared in January 2020 by surveying professional Wilbert Acuña Acuña, with an area of 1207 square meters, what those improvements consisted of, and the amount corresponding to their value. Furthermore, the expenses for fencing and planting crops were not established (there is no evidence to this effect).

VI. PUBLIC-DOMAIN STATUS (DEMANIALIDAD) OF THE MARITIME-TERRESTRIAL ZONE (ZONA MARÍTIMO-TERRESTRE) AND ITS LEGAL REGIME

- Given the underlying issue raised by the challenge to the contested action, before analyzing it, we must precisely define the concept of the maritime-terrestrial zone. Throughout human history, the coast has been recognized as having great economic and commercial importance, as well as importance for security—with respect to national defense—for any country or state organization. Thus, as regards our country, the coastline has remained dedicated to public use since colonial times. Initially, the reserved area was one mile wide, which is why it was known—and continues to be known in our time—as the “maritime mile” (“milla marítima”). The most significant regulations governing Costa Rica’s coastal zone began with Law number 162, of veintiocho de junio de mil ochocientos veintiocho, shortly after independence from the Spanish Crown was declared and during the formation of the Costa Rican State.

That law incorporated an earlier provision from the colonial era (Royal Decree (Real Cédula), of quince de octubre de mil setecientos cincuenta y cuatro) by establishing a one-maritime-mile reserve along the coasts of both seas, which was maintained throughout all legislation enacted in the nineteenth century. That same public-domain status was recognized in the General Code of mil ochocientos cuarenta y uno, which deemed the ebb and flow of the sea and its shores to be in the public domain; in Law number 7, of treinta y uno de agosto de mil ochocientos sesenta y ocho, which reaffirmed that lands within the maritime mile could not be claimed (“indenunciabilidad”); in the Water Law (Ley de Aguas), number 8, of veintiséis de mayo de mil ochocientos ochenta y cuatro, which designated that strip of land as the “maritime-terrestrial zone,” expressly dedicated it to the public domain, and consequently incorporated it into the national patrimony; and, lastly, in the Fiscal Code of mil ochocientos ochenta y cinco, which prohibited the conveyance of lands extending one mile inland along the coasts of both seas.

In the twentieth century, the first legislation to refer to the maritime-terrestrial zone was Law number 75, of treinta de agosto de mil novecientos veinticuatro, which reaffirmed the public-domain character of these lands and the impossibility of exploiting or enjoying their usufruct. Likewise, Law number 11, of 22 de octubre de mil novecientos veintidós, precisely established its extent by delimiting it as mil setecientos sesenta y dos metros—the exact measurement of one mile—from the ordinary high-tide line (pleamar ordinaria), and quinientos metros along both banks of rivers. This measurement remained in effect until mil novecientos cuarenta y dos, when, pursuant to Law number 19, of doce de noviembre, and Law number 201, of veintiséis de enero de mil novecientos cuarenta y tres, its extent was reduced to doscientos metros along both coasts. This resulted in the first removals from the public domain (desafectaciones) of this property with respect to all lands beyond the established boundary and their consequent private appropriation; that is, as of those two provisions, with the exception of the doscientos metros measured from the ordinary high-tide line, the remaining mil seiscientos setenta y dos metros ceased to be in the public domain once they became capable of conversion to private ownership.

Nevertheless, the lands within the doscientos metros excepted by the two aforementioned laws continued to be public-domain property, incapable of conversion to private ownership because they were inalienable and not subject to acquisitive prescription (imprescriptibles). This measurement of the maritime-terrestrial zone, together with the public-domain character of the lands contained therein, was reaffirmed in then-current Article 7 of the Land and Colonization Law (Ley de Tierras y Colonización), number 2825, of catorce de octubre de mil novecientos sesenta y uno, and repeated in the Ley Forestal, number 4465, of veinticinco de noviembre de mil novecientos sesenta y nueve, and in the Tourism Development Law for the Maritime-Terrestrial Zone (Ley de Urbanización Turística de la Zona Marítimo Terrestre), number 4558, of veintidós de abril de mil novecientos setenta. It must be noted that, through Transitory Provision III of Law number 4558, of veintidós de abril de mil novecientos setenta, ciento cincuenta metros of the doscientos metros—following the first cincuenta metros measured from the high-tide line—were removed from the public domain by authorizing private parties who had possessed lots or properties in that sector for more than treinta años, quietly, publicly, peacefully, and without interruption, to register them through possessory-information proceedings (informaciones posesorias) before the judicial—not administrative—authorities.

In view of the large number of abuses committed while that provision was in force—that is, from doce de mayo de mil novecientos setenta—it was repealed by Law number 5602, of cuatro de noviembre de mil novecientos setenta y uno, which entered into force upon its publication in La Gaceta number 206, of catorce de octubre de ese año; that is, it remained in force for diecisiete meses y dos días. Finally, on dos de marzo de mil novecientos setenta y siete, the Maritime-Terrestrial Zone Law (Ley de la Zona Marítimo Terrestre), number 6043, was enacted and remains in force to date; it maintained the public-domain status of the doscientos metros extending along the country’s coastline. Based on the foregoing historical account of the regulations governing the maritime-terrestrial zone, it must necessarily be concluded that it was always characterized and treated as public-domain property (bien demanial) (state-owned, public estate, or public-domain property), thereby possessing all attributes of public-domain status: inalienability, immunity from acquisitive prescription, immunity from attachment (inembargabilidad), and subjection to the police power with respect to its use and exploitation, as stated by the First Chamber of the Supreme Court of Justice (Sala Primera de la Corte Suprema de Justicia) in judgment number 7, at las quince horas cinco minutos del veinte de enero de mil novecientos noventa y tres: “...It is therefore clear, without detracting from the aforementioned precedent from the colonial era, that since Costa Rica’s inception as an independent State, the land reserve extending along both coastlines has not formed part of the vacant lands (baldíos)—the Crown lands of the Colony—but has always been subject to a distinct legal regime, namely that applicable to public-domain property, and therefore has not been capable of conversion to private ownership.

The legislation on this subject enacted throughout the twentieth century—culminating in the current Ley sobre la Zona Marítimo Terrestre No.6043 de 2 de marzo de 1977—clearly maintained the designation of the lands within that zone as public-domain property. As a result of the legislative developments of the nineteenth century, the maritime-terrestrial zone comprised the portions of the coasts of both seas washed by the ebb and flow of the tide, extending one mile inland. It also included the banks of rivers up to the point where they were navigable or affected by the tides. This century’s legislation progressively defined the extent of the zone and the elements forming part of it, but at no time denied its character as public-domain property and, consequently, its immunity from acquisitive prescription and its inalienability; [...] From this brief review of the legislation concerning the maritime-terrestrial zone, it is easy to conclude that the strip of 200 metros measured from the ordinary high-tide line along both coasts, defined as part of the maritime-terrestrial zone by Article 9 of the current Ley sobre la Zona marítimo terrestre, has been in the public domain—and the lands contained therein have been public-domain property—since 1828, at least.

The changes introduced on this subject by the legislation of the last century and the present one never generally removed these 200 metros from the public domain; rather, the legislation predating 1942 and 1943 established a wider strip—the so-called maritime mile—but never a narrower one...” (Considerando II. Emphasis not in the original.) By virtue of the foregoing, and pursuant to Article 6 of the Political Constitution (Constitución Política), the maritime-terrestrial zone constitutes public-domain property of the Nation, a characterization reinforced by Article 3.1 of the Ley de Aguas, “Article 3.- The following are likewise national property: I.- Beaches and maritime zones”; and Article 1° of the Ley de la Zona marítimo terrestre, insofar as it states verbatim: “The maritime-terrestrial zone forms part of the national patrimony, belongs to the State, and is inalienable and not subject to acquisitive prescription.

Its protection, as well as that of its natural resources, is an obligation of the State, its institutions, and all inhabitants of the country. Its use and exploitation are subject to the provisions of this Law.” The Constitutional Chamber (Sala Constitucional) ruled to the same effect in judgments number 2000-10466 and 2002-3821, as did the Third Section of the Contentious-Administrative Court (Sección Tercera del Tribunal Contencioso), exercising nonhierarchical review of legality (control no jerárquico de legalidad), in decision number 128-2001, at las ocho horas del dieciséis de febrero del dos mil uno: “...VI.- Correspondingly, the maritime-terrestrial zone forms part of the national patrimony, belongs to the State, and is inalienable and not subject to acquisitive prescription. Its protection is an obligation of the State and its institutions—including, of course, the corresponding Municipalities—and even of all inhabitants of the country. Its use and exploitation are subject to the provisions of Ley No. 6043 sobre la Zona Marítimo Terrestre.”

VII.Having established the special dedication (afectación) of the maritime-terrestrial zone, it is now necessary to determine precisely which property or areas are included within this special legal-protection regime. Law number 6043 itself specifies them in Article 9: “[...] the strip doscientos metros wide extending along the entire Atlantic and Pacific coastlines of the Republic, regardless of its nature, measured horizontally from the ordinary high-tide line, together with the lands and rocks exposed by the sea at low tide. For legal purposes, the maritime-terrestrial zone includes islands, islets, and sea rocks, as well as all land or natural formations rising above sea level within the Republic’s territorial sea. Isla del Coco, which shall remain under the direct ownership and possession of the State, and such other islands whose ownership or administration is determined by this law or by special laws, are excepted.”

Likewise, pursuant to Article 4 of the Regulations to this Law, Decreto Ejecutivo número 7841-P, del dieciséis de diciembre de mil novecientos setenta y siete, it encompasses: “[...] the mangroves or saltwater forests located along the mainland or island coastlines and estuaries of the maritime-terrestrial zone (zona marítimo terrestre) constitute a Forest Reserve and are subject to the Ley Forestal and to all the provisions of that decree [número 7210-A, del diecinueve de julio de mil novecientos setenta y siete]. The restricted zone begins at the vegetation line along the banks of the estuaries and at the boundary of the mangroves or saltwater forests when they extend more than fifty meters beyond the ordinary high-tide line.” The maritime-terrestrial zone is divided into two zones: the public zone, comprising the strip fifty meters wide, measured from the ordinary high-tide line, and consisting of the shoreline, seashore, or coast extending along permanent tidal inlets and estuaries to the point where they are appreciably affected by the tides and exhibit defined marine characteristics (Article 2, subsection h), of the Regulations to the Ley de la Zona Marítimo Terrestre, Decreto Ejecutivo número 7841-P); and the restricted zone, consisting of the remaining one hundred fifty meters.

By virtue of the foregoing, the following form part of the public zone of the maritime-terrestrial zone: the tidal inlet (ría), defined as the part of a river near its entry into the sea and extending to the point reached by the tides (subsection f) of Article 2 of the aforementioned Decreto Ejecutivo número 7841-P); consequently, in relation to the provisions of Article 9 of the Law governing this subject matter, the two-hundred-meter strip adjoining tidal inlets also constitutes maritime-terrestrial zone; “the islets, rocky outcrops, and other small areas and natural formations projecting above the sea” (final paragraph of Article 10 of the Ley de la Zona Marítimo Terrestre); and mangroves, pursuant to Article 11 of the aforementioned Law. “The area occupied by all mangroves along the mainland and island coastlines and estuaries of the national territory also constitutes public zone, regardless of its extent”; their incorporation into the public domain (demanio) dates back to mil novecientos cuarenta y dos, under the Ley de Aguas, a circumstance that precludes their acquisition of title by private parties.

It should be noted that Article 4 of the Regulations provides that, in such cases, the restricted zone begins at the vegetation line along the banks of the estuaries and at the boundary of the mangroves or saltwater forests when they extend more than fifty meters beyond the ordinary high-tide line; this is highly significant because it extends the concept of the maritime-terrestrial zone to portions of the national territory that may be located kilometers from the coast, meaning that lands adjoining a mangrove cannot be subject to lawful possession. In view of the ecological importance of mangroves, Article 44 of the Ley Forestal, in conjunction with Article 17 of the Ley Orgánica del Ambiente, requires the Ministerio de Ambiente y Energía to conduct the corresponding environmental impact assessment (estudio de impacto ambiental) before granting any permit for their use; and the maritime islands, islets, and rocky outcrops, as well as the land and rocks exposed by the sea at low tide, pursuant to the second paragraph of Article 9 of Ley número 6043), a status already conferred by the Ley de Aguas, número 276, de veintisiete de agosto de mil novecientos cuarenta y dos, in its Article 75, which states: “The islands already formed or that may form within the maritime-terrestrial zone or in the navigable part of rivers and in tidal inlets and river mouths are the property of the State”; this status was maintained by Decreto-Ley número 11, de veintisiete de julio de mil novecientos cuarenta y ocho, as amended by número 803, de dos de noviembre del siguiente año, in the following terms: “confirms and proclaims National Sovereignty over the entire submarine platform or continental and insular shelf adjacent to the mainland and island coasts of the national territory, regardless of the depth at which it lies, reaffirming the Nation’s inalienable right to all natural resources existing on, in, or beneath that shelf or platform”; and by subsection c) of Article 7) of the Ley de Tierras y Colonización, número 2825, de catorce de octubre de mil novecientos sesenta y uno.

It should be clarified that, in the case of rocky outcrops, the concept of public zone applies to the entire natural formation, and in the case of islands, to the fifty meters adjoining the high-tide line, with all remaining land deemed restricted zone (Article 10 of Ley número 6042), unless a mangrove exists, in which case it is deemed public zone, as indicated above.

VIII.It bears recalling that the public zone has been designated for the free use, access, and transit of all persons; consequently, any permit or concession, as well as the collection of the corresponding fee, pertaining to a location within the public zone of the maritime-terrestrial zone is null and void (as held in administrative decision número 148-2022, de las nueve horas cincuenta minutos del treinta de marzo del dos mil veintidós, issued by the Sección Tercera del Tribunal Contencioso Administrativo), except for those serving a public purpose, such as “[...] the construction of industrial plants, sport or artisanal fishing facilities, port works, mariculture programs, or other similar establishments or facilities, ...” (Article 18 of Ley 6043), whose location near the sea is essential to their proper operation. In all cases, they must have the required authorizations from MOPT, INVU, ICT, and the respective municipality, while at all times having regard “[...] to the public use for which they are intended, or to whether they concern the establishment and operation of State-owned tourism facilities of evident benefit to the country” (first paragraph of Article 22 of the Ley de la Zona Marítimo Terrestre).

Likewise, with regard to natural resources contained within the public zone, it should be noted that flora and fauna may not be exploited, trees cut down, or products extracted from the coast without the required authorization—whether a permit or concession—in this case from the Dirección de Vida Silvestre of the Ministerio de Ambiente y Energía, following an environmental impact assessment, pursuant to Article 17 of the Ley Orgánica del Ambiente. In addition, the respective municipalities are responsible for facilitating access to beaches for people’s enjoyment and transit; accordingly, local government must prevent any restrictive action that obstructs such free access to beaches. This oversight function also extends to evicting trespassers and even destroying or demolishing any structures, facilities, or works erected, whether merely fences, shacks, sales stands, or dwellings, without incurring any liability (as held by the Tribunal Contencioso Administrativo, Sección Tercera, in decision número 7900-98).

Pursuant to Article 39 of the Ley de la Zona Marítimo Terrestre, concessions may be granted only within the restricted zone of the maritime-terrestrial zone and are administered by the municipalities (Article 40 of the aforementioned Law), except where a protected wilderness area (área silvestre protegida)—forest reserves, protective zones, national parks, biological reserves, national wildlife refuges, wetlands, or natural monuments—exists, which, pursuant to Articles 32 of the Ley Orgánica del Ambiente and 73 of the Ley de la Zona Marítimo Terrestre, is under the administration of the Ministerio de Ambiente y Energía.

IX. REGARDING THE SPECIFIC CASE

Having reviewed the record, this Chamber finds that the claim brought is unfounded and must be dismissed for the reasons analyzed below. As the claim was pleaded and as reflected in the closing arguments made at the oral and public trial hearing, the plaintiff’s arguments center on the assertion that Mr. Cruz Zeledón has exercised over the land at issue in this proceeding the possession required to acquire it by adverse possession (usucapir), pursuant to Articles 853 through 864 of the Código Civil. The evidence submitted in the case file (see proven fact 03 of this judgment) establishes that the claimant has in fact exercised acts of possession over the land described in the unregistered survey plan prepared in enero del 2020 by the surveying professional Wilbert Acuña Acuña, having an area of 1207 square meters, since 1998, when he acquired the property bordering this land to the north, which is registered in the Puntarenas registry district, at volume one thousand five hundred eleven, folio four hundred forty-five, number ten thousand seven hundred forty-seven, entry three.

However, based on the evidence submitted in the case file, it is also true that the real property for which the claimant seeks recognition of ownership in this proceeding lies within the maritime-terrestrial zone, as may be seen in the repeatedly cited unregistered survey plan; it has also been demonstrated that it is public land in excess of the surveyed area (demasías) of the lands sold by the Instituto Costarricense de Turismo within the maritime-terrestrial strip between Chacarita and the mouth of the río Barranca (see proven fact 02 of this judgment). Accordingly, it may be established that the land under consideration lies within the maritime-terrestrial zone and therefore constitutes public-domain property (bien demanial), pursuant to Article 01 of Ley N° 6043, Ley sobre la Zona Marítimo Terrestre, and the preceding recital. Consequently, this land is subject to special regulations, and the rules applicable to other real property—specifically those provisions of the Código Civil governing acquisition of property by acquisitive prescription (prescripción positiva), as sought by the claimant—do not apply.

Moreover, given the legal nature of the property at issue, it would be improper and plainly contrary to the governing law to recognize in the plaintiff any property right or any attribute thereof (possession, usufruct, alteration and conveyance, defense and exclusion, restitution and compensation, pursuant to Article 264 of the Código Civil), because the property has been withdrawn from private commerce (inalienability (inalienabilidad)); consequently, it likewise cannot be acquired or lost through ten-year possession—adverse possession (posesión decenal-usucapión). Thus, given that, as explained above, the area in which the land is located has held public-domain status (demanialidad) since the colonial period, no title of ownership could be granted through possession thereof, as sought here. Nevertheless, it should be noted that the sole exception to this regulation arises when a statutory provision permits some form of authorization for private use of the maritime-terrestrial zone. In this regard, this Tribunal stated as follows:

“V.- …the legal restrictions governing the maritime-terrestrial zone (zona marítimo terrestre), as an area subject to a special public-domain classification (calificación demanial especial), necessarily lead to upholding the allegations contained in the State’s action, because they provide the legal and factual basis for its claim, as the properties are technically identified in the cadastre as overlapping the restricted area of the maritime-terrestrial zone… Such public-domain property (bienes de dominio público) is characterized as inalienable (inalienable), not subject to prescription (imprescriptible), and immune from attachment (inembargable), and is consequently outside private commerce. That is, the existing public-domain status (demanialidad), pursuant to the cited legislation, cannot be challenged on the basis of a superior right or good-faith acquisition, since public domain means the body of property subject to a special legal regime that is stringent and distinct from that governing private property and that, in addition to belonging to or being administered by public legal entities, is allocated or designated for public-use purposes and neither belongs nor may belong individually to private parties (except through removal from the public domain by law)….” Accordingly, public-domain property may be removed from the public domain (desafectarse) or converted into private property only through a normative act of equal rank, that is, by statute (Código Civil, Articles 261 and 262; constitutional judgments 5026-97, 7294-98, 2988-99, 11346-06, 2408-07, 11155-07, 13367-12, 10158-13; Sala Primera 230-90 and 189-11; Tribunal Contencioso Administrativo, judgments 7747-1985-I, 9172-1987-I, 190-12-II, 84-14-II, 46-09-IX), and removal through regulations, a judicial ruling, or administrative action is inadmissible. (See judgment number 69-2018-II, de las ocho horas treinta minutos del treinta de octubre del dos mil dieciocho.)

Accordingly, property located in the maritime-terrestrial zone is public-domain property and is therefore characterized as inalienable, not subject to prescription, and immune from attachment; consequently, it is outside private commerce. The only way in which any type of right over such property may arise is through an exception established by statute. Among the statutory exceptions are those applicable to natural persons who, without qualifying as settlers (pobladores)—persons who held a lot within the maritime mile before the enactment of the Ley de la zona marítimo terrestre, that is, before nineteen seventy-seven, and for a period exceeding ten years—occupied the maritime-terrestrial zone, even without authorization, before the Ley de la zona marítimo terrestre entered into force and therefore hold no permit. With respect to such persons, Articles 44 and 70 and Transitorio VII of the same Ley sobre la Zona Marítimo-Terrestre, number 6043, establish two such exceptions to the parameters governing private use within the maritime-terrestrial zone.

The granting of use permits (permisos de uso) to them is lawful, subject to special conditions, since it is permitted only “[...] in those cases in which the conditions of the zone are not adversely affected, the free use of the public zone is not obstructed, and implementation does not in any way limit the future implementation of the Regulatory Plan (Plan Regulador). (Article 19 of Ley 6043).” (Decision number 10163-99 of the Sección Tercera del Tribunal Contencioso Administrativo); this also allows municipalities to collect a fee (canon). Such a permit must not, however, under any circumstances be regarded as recognition of a possessory right (derecho de posesión) over those areas, but solely as a priority right in the granting of future concessions once the respective coastal regulatory plan (plan regulador costero) has been approved. Thus, where conditions are equal, the administration must give preference in granting the concession to the person who has exercised continuous possession quietly, publicly, and peacefully, which demonstrates subjection to land-use regulations (normativa territorial).

The foregoing exceptions likewise cannot be applied in this specific case because the plaintiff did not possess the land before the date on which that law entered into force, but only beginning in 1998 (see proven facts 01 and 03 of this judgment), and he is not requesting recognition as an occupant or the granting of any type of concession. It must also be noted that such possession does not create any type of ownership right, as claimed, but merely priority should a future concession be requested.

Additionally, the Ley sobre la Zona Marítimo Terrestre establishes another exception for the specific area in which the land at issue is located, providing as follows in Article 76: “Article 76.- The Municipalidad del cantón central de Puntarenas is authorized to sell to the current occupants or, failing that, to any interested parties, the excess areas (demasías) of the lands sold by the Instituto Costarricense de Turismo within the maritime-terrestrial strip between Chacarita and the mouth of the río Barranca, following an appraisal of such excess areas by the Dirección General de la Tributación Directa. The Municipalidad shall use the proceeds from those sales for sanitation works in the communities located east of La Angostura. / The Municipalidad shall reserve an area at least fifty meters wide from the ordinary high-tide line (pleamar ordinaria), to be used for constructing a promenade, which it shall plan jointly with the Instituto Costarricense de Turismo. / Article 2º of Law Nº 4071 of 22 de enero de 1968 is hereby amended accordingly. / It shall likewise reserve an area at least fifty meters wide (50 m) from the ordinary high-tide line, to be used for constructing the section of the scenic highway between ‘La Vuelta,’ located in district twelve, Chacarita, and the vicinity of the ‘Yacht Club,’ in district one, Puntarenas; because this is a route within the national road network, it shall be under the responsibility of the Ministerio de Obras Públicas y Transportes (MOPT), with road maintenance under the responsibility of the Consejo Nacional de Vialidad (Conavi).” Accordingly, pursuant to the preceding article, the only means by which the land may be removed from the public domain and become the property of a private party is for the Municipalidad de Puntarenas, after first complying with the requirements established in that article and observing the stated restrictions, to decide, in the exercise of its powers, to sell the land to the plaintiff, since he is its current occupant.

As a consequence of all the foregoing, the inherent characteristics of the legal regime applicable to this type of property (public-domain property) make it impossible, by virtue of the aforementioned inalienability, to grant a private party—in this case, the plaintiff—a right to title (derecho de titulación) over land that he claims to have possessed or occupied (regardless of the period exceeding twenty years that he alleges). Nor would it be feasible to declare in his favor a possessory right or superior possessory right (mejor derecho posesorio) allowing him to benefit from or privately enjoy that coastal strip. Regardless of the acts of possession (actos posesorios) that the plaintiff claims to have exercised over the land, such circumstances could not give rise to a right to title or registration in his name of areas that, owing to their characteristics, have been determined to form part of the public domain, nor could they result in him being regarded, as requested, as the owner of those properties, except through the procedure established in the cited Article 76.

It must be stated that, for this type of public property, the effects of its legal framework preclude acquisitive prescription (usucapión o prescripción adquisitiva), as follows from its immunity from prescription; therefore, the passage of time during which the property has been used (or possessed) does not provide a basis for appropriating it. Consequently, the request that he be declared the owner of the land at issue in this proceeding has no support or protection under the legal system, as established by section 7 of Ley No. 6043, Ley sobre la Zona Marítimo Terrestre. From the perspective of a private party, this entails a legal impossibility of acquiring ownership through the doctrine of acquisitive prescription, and consequently, the Public Administration shall never lose the title to and administrative authority it exercises over such property unless and until it is removed from the public domain. This claim must therefore be rejected.

As to the second claim brought by the plaintiff, seeking payment for the improvements (mejoras) made to the aforementioned land, the care he has provided to it, and the increase in value resulting from his possession, care, and improvements, that claim must be rejected. First, the plaintiff neither alleged nor proved that he held lawful title (justo título) authorizing acts of possession that would legitimize his occupation of public-domain land, or that his possession of the parcel was in good faith or lawful, under the terms established in Article 154 of the Ley General de la Administración; therefore, no compensation for improvements would be appropriate. Furthermore, the evidence collected does not establish the existence of improvements for which payment is due. In this regard, it must be recalled that, under section 41.1 of the Código Procesal Civil, the interested party bears the burden of proving its assertions, particularly in a civil claim against the public treasury (gestión civil de hacienda), and that burden has not been met here.

There is no evidence whatsoever of the alleged improvements; no photographs, expense receipts, or other relevant evidence were submitted. The only evidence is witness testimony, specifically the statements of Miguel Jiménez Cordero and Róger Cruz Zeledón, from which the only fact that may be derived is that a fence and green area exist; however, it cannot be determined whether they are located on the property acquired by the plaintiff or on the land at issue here, and that evidence is therefore inconclusive. Consequently, this judicial body lacks evidence establishing the existence of any amount due in his favor. Accordingly, the absence of timely evidence on this matter precludes a contrary decision and leads to the rejection of that claim without need for further consideration.

X. DEFENSES

The Municipalidad de Puntarenas raised the defenses of lack of standing to sue (falta de legitimación activa), lack of standing to be sued (falta de legitimación pasiva), and failure to state a valid legal right (falta de derecho). As to standing to sue, the plaintiff demonstrates a clear connection to the subject matter of the proceeding insofar as he seeks protection of what he considers to be a subjective right (derecho subjetivo) and legitimate interest (interés legítimo) in obtaining title based on having possessed the land he occupies for more than 10 years, as well as the right to obtain monetary compensation for the improvements made. That connection is supported by section 10, subsection one, paragraph a), of the Código Procesal Contencioso Administrativo, and the defense of lack of standing to sue must therefore be rejected. As to the defense of failure to state a valid legal right, it must be upheld pursuant to the cited legislation and the factual grounds set forth above, because the plaintiff does not hold the right invoked in support of his claims. On the contrary, the action brought must be denied because no ownership title based on possession may be granted as requested, rendering the requested relief inadmissible. Accordingly, the complaint must be dismissed in its entirety.

XI. COSTS

Pursuant to Article 193 of the Code of Administrative Procedure (Código Procesal Contencioso Administrativo), attorney’s fees and procedural costs (costas personales y procesales) constitute a burden imposed on the losing party by virtue of having lost, and waiver thereof is appropriate only when, in the Court’s judgment, there was sufficient reason to litigate, or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In the case under consideration, this collegiate body finds no reason to apply the exceptions established by the applicable regulations and depart from the principle that costs are awarded against the losing party. Accordingly, both attorney’s fees and procedural costs are imposed on Mr. JOSÉ ENRIQUE CRUZ ZELEDÓN, together with interest to be calculated from the date the award of costs becomes final until actual payment thereof, at the statutory rate established by Article 1163 of the Civil Code (Código Civil). It is ordered that these amounts shall be determined and assessed during the judgment-enforcement phase (fase de ejecución de sentencia), once this ruling becomes final.

THEREFORE

The defense of lack of standing to sue (falta de legitimación ad causam activa) is rejected, and the defense of lack of a legal right (falta de derecho) raised by counsel for the Municipalidad de Puntarenas is sustained. Consequently, the complaint is dismissed in its entirety. Both attorney’s fees and procedural costs are imposed on Mr. JOSÉ ENRIQUE CRUZ ZELEDÓN, together with interest to be calculated from the date the award of costs becomes final until actual payment thereof, at the statutory rate established by Article 1163 of the Civil Code. It is ordered that these amounts shall be determined and assessed during the judgment-enforcement phase, once this ruling becomes final. THAT IS ALL. MUNICIPALIDAD DE PUNTARENAS Nº N° 2024000947 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SECCIÓN TERCERA. SAN JOSÉ, GOICOECHEA, a las trece horas con once minutos del dieciseis de Febrero del dos mil venticuatro.- Proceso de conocimiento, con trámite de juicio oral establecido por el señor JOSÉ ENRIQUE CRUZ ZELEDÓN, portador de la cédula de identidad número 6-184-178; en contra de la MUNICIPALIDAD DE PUNTARENAS, representada por su apoderada especial judicial la Licenciada ADRIANA NÚÑEZ QUINTANA, portadora de la cédula de identidad número 1-973-118, carnet profesional número 16103. Interviene el Licenciado RAFAEL BROOCKS MC KENZIE, portador de la cédula de identidad número 6-162-827, carnet profesional número 8041, como apoderado especial judicial de la parte actora.

CONSIDERANDO

I.ASPECTOS PRELIMINARES.- A) Se emite esta resolución según las formalidades establecidas en la Ley N° 9342, Código Procesal Civil (en adelante CPC), y el Reglamento sobre Expediente Judicial Electrónico ante el Poder Judicial (en adelante REJEPJ), aprobado por Corte Plena en el artículo XXXI de la sesión N° 22-13, celebrada el 20 de mayo de 2013; B) El fallo se adopta por unanimidad, una vez realizada la respectiva deliberación, con la redacción de la resolución a cargo del informante, juzgadora Rodríguez Cubero, con el voto y opinión concurrente de las personas juzgadoras Chaves Torres y Perera León.

II. ANTECEDENTES PROCESALES

- A continuación, se hace un recuento del iter procesal: 1.- Las pretensiones de la parte actora, según el escrito de demanda presentado en fecha 04 de marzo del 2020 y ajustes realizados en la audiencia preliminar llevado a cabo el día veinte de mayo del dos mil veintidós, son para que en sentencia se establezca: "...1. Que se declare con lugar la presente demanda civil de hacienda de usucapión, y como consecuencia de ello se declare que el actor ha usucapido el terreno a que se contrae esta Iitis, y como consecuencia de ello, en la hipótesis de que la demandada acredite se (sic) la titular del referido terreno se decrete la nulidad del título por haber usucapido el actor, y se emitían (sic) los mandamientos de estilo al Registro Nacional a los efectos de que inscriba el terreno dicho a nombre del demandante, lo que por supuesto conllevará a que sea catastrado el plano que se aporta con esta acción. /2.

Que en la hipótesis de que sea desestimada la pretensión anterior, y principal, se condene a la demandada al pago de las mejoras que ha introducido el actor al mencionado terreno, al cuido que ha dado a este, a la plusvalía que su posesión, cuido, y mejoras han producido en el terreno de marras, con derecho de retención hasta su efectivo pagos (sic), suma que será fijada en ejecución de sentencia según lo determine un perito experto en esa oportunidad. /3. Que en la hipótesis de que la demandada se oponga de manera infundada, temeraria, y/o impertinente se le condene al pago de ambas costas de esta acción...” (ver imágenes 01 a 08 y 111 a 114 del expediente judicial digital escaneado en un único archivo PDF y respaldo digital de la audiencia preliminar).

  1. 2Con auto de las doce horas cincuenta y tres minutos del dos de abril del dos mil veinte este Tribunal dio traslado de la demanda a la Municipalidad de Puntarenas (ver imágenes 21 a 23 del expediente judicial digital escaneado en un único archivo PDF).
  2. 3Mediante escrito de fecha 27 de julio del 2020 la representación de la Municipalidad de Puntarenas contestó negativamente la demanda, solicitó que fuese declarada sin lugar e interpuso las excepciones de falta de legitimación ad causam activa y falta de derecho, y que se condene a la parte actora al pago de ambas costas del proceso con sus respectivos intereses (ver imágenes 31 a 35 del expediente judicial digital escaneado en un único archivo PDF).
  3. 4Con auto de las nueve horas veintiún minutos del tres de agosto del dos mil veinte, este Tribunal tuvo por contestada la demanda en tiempo y forma por la Municipalidad de Puntarenas y dio audiencia a la parte actora por 3 días hábiles de las excepciones interpuestas (ver imagen 37 del expediente judicial).
  4. 5La audiencia preliminar establecida en el ordinal 90 del CPCA fue celebrada a partir de las nueve horas diecinueve minutos del veinte de mayo del dos mil veintidós, en la que se realizaron las diferentes etapas de la misma. Se establecieron las pretensiones en la forma ya definida en el punto uno de este apartado. Se determinaron como hechos controvertidos el 2, 3, 4 y 5 de la demanda y se admitió la prueba documental pertinente de ambas partes. A la parte actora se le admitió el testimonio de los señores Miguel Jiménez Cordero y Róger Cruz Zeledón y a la parte demandada el testimonio del señor Luis Diego León Quirós como testigo-perito. Diligencias que fueron grabadas en el sistema electrónico correspondiente y constan en la carpeta de documentos asociados del expediente virtual (ver imágenes 112 a 114 del expediente judicial digital escaneado en un único archivo PDF y respaldo digital de la audiencia preliminar).
  5. 6La audiencia de juicio se realizó el veintinueve de enero del dos mil veinticuatro y fue llevado a cabo por el Tribunal Colegiado número tres, integrado por las personas juzgadoras Francisco José Chaves Torres, Vernor Perera León y Lindsay Rodríguez Cubero, en condición jueza ponente, con el auxilio de la técnica judicial Diana Carolina Mejía Aguilar. Se contó con la presencia de la parte actora y demandada, junto con sus representantes legales. Se evacuó los testimonios de los señores Miguel Jiménez Cordero, Roger Cruz Zeledón y Luis Diego León Quirós. Posteriormente, las partes rindieron conclusiones, luego de lo cual el Tribunal les informó que de conformidad con el artículo 111 del CPCA, la sentencia sería dictada dentro de los quince días hábiles siguientes, luego de lo cual les sería notificada a los medios señalados y en los plazos establecidos por la Ley de Notificaciones Judiciales para tales efectos; y se cerró la audiencia complementaria (ver imágenes 125 a 128 del expediente judicial digital escaneado en un único archivo PDF y respaldo digital del juicio público)
  6. 7No existen defectos u omisiones que provoquen nulidad procesal de lo actuado en este asunto.

III. OBJETO DEL PROCESO

- La pretensión principal establecida por la parte actora en el presente proceso contencioso es la primera, que es de naturaleza declarativa, en la que se solicita que se establezca que el señor Cruz Zeledón ha usucapido el terreno que se describe en el plano sin catastrar de fecha enero del 2020, con un área de 1207 metros cuadrados, que es un terreno que colinda al sur con un inmueble de su propiedad, desde el 03 de julio de 1998. Señalando que desde esa fecha adquirió de forma originaria la posesión del inmueble de marras, ejerciéndola de forma quieta, pública, pacífica, ininterrumpida y a título de dueño. Posesión que ha consistido en cercar el terreno, anexarlo al terreno de su propiedad, cultivando plantas ornamentales, frutales, césped, darle mantenimiento y en general el cuidado de éste, ejerciendo todos los atributos de propietario por espacio de 22 años y sin ser perturbado por ninguna persona física o jurídica.

Que es hasta enero del 2020 cuando se presenta a catastrar el plano indicado que le informan en la Municipalidad que ese terreno está bajo esa Administración demandada y que no puede titular el terreno por la vía de información posesoria. Adicionalmente, solicita que en caso de que no se pueda establecer su persona como titular del terreno que se le cancelen las mejoras que ha introducido al mismo, suma que será fijada en ejecución de sentencia. Finalmente pidió la condena en costas al Estado. La representación de la Municipalidad de Puntarenas se opuso a la acción e interpuso las defensas de falta de legitimación activa y falta de derecho. Corresponde, entonces, ingresar a examinar si le asiste o no el derecho a la parte accionante en relación con lo peticionado.

IV. HECHOS PROBADOS

De importancia para el dictado de esta resolución, se tienen los siguientes hechos como debidamente demostrados conforme la sana crítica racional, sea que así se desprenda de la comunidad de pruebas aportadas y admitidas en este proceso, o porque las partes los han aceptado.

  • 1)En fecha 03 de julio del año 1998, el señor Cruz Zeledón adquirió la finca inscrita en el partido de Puntarenas, al tomo mil quinientos once, folio cuatrocientos cuarenta y cinco, número diez mil setecientos cuarenta y siete, asiento tres, con una medida de mil ciento sesenta y cuatro metros con treinta y ocho decímetros cuadrados, con los siguientes linderos: al norte con calle pública, al sur con carretera, al este con lote 49 y oeste con Lote 51 (ver escritura número cuatrocientos treinta y siete del notario público Marco Aurelio Zúñiga Angulo de fecha tres de julio de mil novecientos noventa y ocho, que consta a imágenes 15 a 16 del expediente judicial escaneado en un único archivo PDF y consulta realizada el día de hoy en el sistema digital de consultas del Registro Nacional).
  • 2)Que el terreno que se describe en el plano sin catastrar confeccionado en enero del 2020 por el profesional en topografía Wilbert Acuña Acuña con un área de 1207 metros cuadrados se encuentra ubicado en las demasías de terrenos que fueron vendidos por el Instituto Costarricense de Turismo en la franja marítimo terrestre comprendida entre Chacarita y la desembocadura del río Barranca (ver declaración del testigo-perito León Quirós en respaldo digital del juicio público y plano visible a imagen 19 del expediente judicial escaneado en un único archivo PDF) 3.) Que desde fecha 03 de julio del año 1998, el señor Cruz Zeledón ha realizado acciones para anexar el terreno objeto de este proceso a la finca inscrita en el partido de Puntarenas, al tomo mil quinientos once, folio cuatrocientos cuarenta y cinco, número diez mil setecientos cuarenta y siete, asiento tres (ver declaraciones de los testigos Miguel Jiménez Cordero y Róger Cruz Zeledón en respaldo digital del juicio público)

V. DE LOS HECHOS NO PROBADOS

- De importancia para la resolución de esta demanda, por no constar prueba aportada al expediente, se tiene como no probado lo siguiente:

  • 1)Que el accionante cuente con título administrativo habilitante o condición jurídica alguna que le confiera la posibilidad jurídica de beneficiarse de un uso privativo sobre la franja de terreno sobre la cual dice ejercer actos posesorios, identificada dentro del plano sin catastrar confeccionado en enero del 2020 por el profesional en topografía Wilbert Acuña Acuña con un área de 1207 metros cuadrados (no existe prueba sobre el particular).
  • 2)Que el actor hubiera introducido mejoras en la franja de terreno sobre la cual dice ejercer actos posesorios, identificada dentro del plano sin catastrar confeccionado en enero del 2020 por el profesional en topografía Wilbert Acuña Acuña con un área de 1207 metros cuadrados en qué consisten y su monto que correspondería a su valor. Además, no se demostraron los gastos por cercado y siembra de cultivos (no hay prueba en este sentido).

VI. DE LA DEMANIALIDAD DE LA ZONA MARÍTIMO-TERRESTRE Y SU RÉGIMEN JURÍDICO

- Por el tema de fondo en el cuestionamiento de la actuación impugnada, previo a su análisis, debemos tener claridad en la precisión de la definición del concepto de la zona marítimo terrestre. A lo largo de la historia de la humanidad, se ha denotado la gran importancia económica, comercial y también de seguridad -en lo atinente a la defensa nacional- que tiene la costa para cualquier país u organización estatal. Así, en lo que respecta a nuestro país, desde la época colonial, el litoral ha permanecido destinado al uso público. En un principio, el área reservada era de una milla de ancho, por lo que se le conocía -y aún en nuestra época- como la "milla marítima". La normativa de mayor relevancia en la regulación de la zona litoral costarricense inicia con la Ley número 162, de veintiocho de junio de mil ochocientos veintiocho, recién declarada la independencia de la Corona Española, y en la etapa de formación del Estado costarricense, en la que se recogió un precepto anterior, de la época colonial (Real Cédula, del quince de octubre de mil setecientos cincuenta y cuatro), al establecerse la reserva de una milla marítima en las costas de ambos mares, que se mantuvo a lo largo de toda la legislación emitida en el siglo XIX.

Esa misma condición de demanialidad se reconoció en el Código General de mil ochocientos cuarenta y uno, que consideró el flujo y reflujo del mar y sus riberas de dominio público; en la Ley número 7, de treinta y uno de agosto de mil ochocientos sesenta y ocho, en que se ratificó la "indenunciabilidad" de los terrenos de la milla marítima; en la Ley de Aguas, número 8, de veintiséis de mayo de mil ochocientos ochenta y cuatro, que denominó esa franja de tierra con la advocación de "zona marítimo terrestre", la cual, expresamente fue afectada como bien de dominio público, y en consecuencia, se incorporó al patrimonio nacional; y por último, en el Código Fiscal de mil ochocientos ochenta y cinco se dispuso la prohibición de enajenar los terrenos comprendidos en una milla de latitud a lo largo de la costa de ambos mares. Ya en el siglo XX., la primera normativa a que hizo referencia la zona marítimo terrestre fue la Ley número 75, de treinta de agosto de mil novecientos veinticuatro, que reafirmó el carácter demanial de estas tierras, así como la imposibilidad de explotar y usufructar de ellos.

Asimismo, la Ley número 11, de 22 de octubre de mil novecientos veintidós, precisó, con exactitud, su extensión, al delimitarla en mil setecientos sesenta y dos metros -medida exacta de una milla-, a partir de la pleamar ordinaria, y de quinientos metros a lo largo de ambos márgenes de los ríos. Esta medida se mantuvo hasta mil novecientos cuarenta y dos, en que a partir de las Leyes número 19, de doce de noviembre, y la Ley número 201, de veintiséis de enero de mil novecientos cuarenta y tres, se redujo su extensión, a doscientos metros para ambas costas; provocando así, las primeras desafectaciones de este bien, en relación a todos aquellos terrenos más allá de la determinación hecha, y su consecuente apropiación particular; es decir, a partir de estas dos disposiciones, y a excepción de los doscientos metros contados a partir de la pleamar ordinaria, el resto de los mil seiscientos setenta y dos metros dejaron de ser de dominio público desde el momento en que pudieron se reducidos a dominio privado.

Sin embargo, los terrenos contenidos en los doscientos metros exceptuados por las dos leyes precitadas, continuaron siendo bienes de dominio público, no reducibles a dominio privado por ser inalienables e imprescriptibles. Esta medida de la zona marítimo terrestre, junto con el carácter demanial de los terrenos allí comprendidos, se reafirmó en el entonces vigente artículo 7 de la Ley de Tierras y Colonización, número 2825, de catorce de octubre de mil novecientos sesenta y uno, y se repitió en la Ley Forestal, número 4465, de veinticinco de noviembre de mil novecientos sesenta y nueve y en la Ley de Urbanización Turística de la Zona Marítimo Terrestre, número 4558, de veintidós de abril de mil novecientos setenta. Sí debe hacerse la advertencia que, con la Ley número 4558, de veintidós de abril de mil novecientos setenta, en su Transitorio III, se desafectaron ciento cincuenta metros de los doscientos metros, después de los primeros cincuenta metros, contados a partir de la pleamar, al autorizarse a los particulares que hubiesen poseído por más de treinta años, en forma quieta, pública, pacífica y sin interrupción, lotes o fincas en ese sector, a inscribirlos por medio del trámite de informaciones posesorias ante las autoridades jurisdiccionales -no administrativas-.

Ante la gran cantidad de abusos que se cometieron al tenor de la vigencia de esta disposición, sea, desde el doce de mayo de mil novecientos setenta, es que se deroga mediante la Ley número 5602, de cuatro de noviembre de mil novecientos setenta y uno, la cual entra en vigencia a partir de su publicación en La Gaceta número 206, del catorce de octubre de ese año; sea que tuvo una vigencia de diecisiete meses y dos días. Finalmente, el dos de marzo de mil novecientos setenta y siete, se promulgó la Ley de la Zona Marítimo Terrestre, número 6043, vigente hasta la fecha, que mantuvo la demanialidad de los doscientos metros a lo largo del litoral del país. En razón del anterior recuento histórico de la regulación normativa de la zona marítimo-terrestre, necesariamente debe concluirse que siempre se le dio el calificativo y trato de bien demanial (dominical, demanio o de dominio público), lo cual le hace acreedora de todas las características de la demanialidad, sea, su inalienabilidad, imprescriptibilidad, inembargabilidad, así como la sujeción al poder de policía en lo relativo a su uso y aprovechamiento, como lo señaló la Sala Primera de la Corte Suprema de Justicia en sentencia número 7, de las quince horas cinco minutos del veinte de enero de mil novecientos noventa y tres: "...Resulta claro entonces, sin demérito del antecedente de la época colonial señalado, que desde el nacimiento de Costa Rica como Estado independiente, la reserva de terreno a lo largo de ambos litorales no ha sido parte de los baldíos -las tierras realengas de la Colonia- sino que siempre ha estado sometido a un régimen jurídico distinto, el propio de los bienes de dominio público y, por lo tanto, no reducibles a propiedad privada.

En la legislación sobre la materia promulgada a lo largo del siglo XX -hasta culminar con la actual Ley sobre la Zona Marítimo Terrestre No.6043 de 2 de marzo de 1977- se mantuvo, obviamente, el calificativo de bienes de dominio público de los terrenos comprendidos en dicha zona. Como resultado de la evolución legislativa del siglo XIX, la zona marítimo terrestre comprendía la parte de las costas de ambos mares bañadas por el flujo y reflujo, extendiéndose hasta la distancia de una milla tierra adentro. Comprendía, además, las márgenes de los ríos hasta el sitio en que fueran navegables o fueran afectados por las mareas. La legislación de este siglo fue precisando la extensión de la zona así como los elementos que formaban parte de ella, pero en ningún momento negó su carácter de bien demanial y, en consecuencia, su imprescriptibilidad e inalienabilidad; [...] De este somero estudio sobre la legislación acerca de la zona marítimo terrestre, es fácil llegar a la conclusión de que la franja de 200 metros a partir de la pleamar ordinaria a lo largo de ambas costas definida como parte de la zona marítimo terrestre por el artículo 9 de la actual Ley sobre la Zona marítimo terrestre, ha sido de dominio público -y los terrenos en ella comprendidos, bienes demaniales- desde 1828, por lo menos.

Las variaciones que la legislación del siglo pasado y del presente han introducido sobre la materia nunca han desafectado en forma generalizada estos 200 metros, siendo más bien que la legislación anterior a 1942 y 1943, establecía una franja mayor en extensión -la llamada milla marítima- pero nunca menor..." (Considerando II. El resaltado no es del original.) En virtud de lo anterior, y al tenor de lo dispuesto en el artículo 6 de la Constitución Política, la zona marítimo terrestre adquiere la condición de bien demanial de la Nación, consideración que es reforzada por el artículo 3.1 de la Ley de Aguas, "Artículo 3.- Son igualmente de propiedad nacional: I.- Las playas y zonas marítimas"; y el artículo 1° de la Ley de la Zona marítimo terrestre, en tanto dispone textualmente: "La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible.

Su protección, así como sus recursos naturales, es obligación del Estado, de sus instituciones y de todos los habitantes del país. Su uso y aprovechamiento están sujetos a las disposiciones de esta Ley." En igual sentido, se pronunció la Sala Constitucional en sentencia número 2000-10466 y 2002-3821; así como la Sección Tercera del Tribunal Contencioso, en funciones de control no jerárquico de legalidad, en resolución número 128-2001, de las ocho horas del dieciséis de febrero del dos mil uno: "...VI.- Correlativamente a lo dicho, la zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su protección es obligación del Estado y sus instituciones –incluidas por supuesto las Municipalidades correspondientes- e incluso de todos los habitantes del país. Su uso y aprovechamiento están sujetos a las disposiciones de la Ley No. 6043 sobre la Zona Marítimo Terrestre."

VII.Determinada la especial afectación de la zona marítimo-terrestre, interesa ahora saber con precisión, qué bienes o áreas comprende este régimen especial de tutela jurídica. Y es la misma Ley número 6043, la que en su artículo 9 nos lo indica: "[...] la franja de los doscientos metros de ancho a todo lo largo de los litorales Atlántico y Pacífico de la República, cualquiera que sea su naturaleza, medidos horizontalmente a partir de la línea de la pleamar ordinaria y los terrenos y rocas que deje el mar al descubierto en la marea baja. Para los efectos legales, la zona marítimo terrestre comprende las islas, islotes y peñascos marítimos, así como toda tierra o formación natural que sobresalga del nivel del océano dentro del mar territorial de la República. Se exceptúa la Isla del Coco que estará bajo dominio y posesión directos del Estado y aquellas otras islas cuyo dominio o administración se determinen en la presente ley o leyes especiales."

Asimismo, conforme al artículo 4 del Reglamento de esta Ley, Decreto Ejecutivo número 7841-P, del dieciséis de diciembre de mil novecientos setenta y siete, abarca: "[...] los manglares o bosques salados que existen en los litorales continentales o insulares y esteros del territorio marítimo terrestre, constituyen Reserva Forestal y están afectados a la Ley Forestal y a todas las disposiciones ese decreto [número 7210-A, del diecinueve de julio de mil novecientos setenta y siete]. Partiendo de la línea de vegetación a la orilla de los esteros y del límite de los manglares o bosques salados cuando éstos se extiendan por más de cincuenta metros de la pleamar ordinaria, comienza la zona restringida." La zona marítimo terrestre está divida en dos zonas: la pública, que comprende la faja de cincuenta metros de ancho, contados de la pleamar ordinaria, compuesta por la litoral, orilla o costa del mar que se extiende por las rías y esteros permanentes, hasta donde éstas sean sensiblemente afectadas por las mareas, y presenten características marinas definidas (artículo 2 inciso h) del Reglamento a la Ley de la Zona Marítimo Terrestre, Decreto Ejecutivo número 7841-P); y la restringida, constituida por los restantes ciento cincuenta metros.

En virtud de lo anterior, son parte de la zona pública de la zona marítimo-terrestre: la ría, definida como la parte del río próxima a su entrada en el mar, y hasta donde llegan las mareas (inciso f) del artículo 2 del citado Decreto Ejecutivo número 7841-P); de manera que en relación con lo dispuesto en el artículo 9 de la Ley que rige esta materia, también es zona marítimo terrestre, la franja de los doscientos metros contigua a las rías; "los islotes, peñascos y demás áreas pequeñas y formaciones naturales que sobresalgan del mar" (párrafo final del artículo 10 de la Ley de la Zona Marítimo Terrestre); los manglares, al tenor de lo dispuesto en el artículo 11 de la citada Ley. "Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional"; cuya incorporación al demanio data de mil novecientos cuarenta y dos, con la Ley de Aguas, circunstancia que impide su titulación por particulares.

Se advierte que el artículo 4 del Reglamento estatuye que la zona restringida en estos casos, parte de la línea de vegetación a la orilla de los esteros y del límite de los manglares o bosques salados, cuando éstos se extiendan por más de cincuenta metros de pleamar ordinaria; lo cual es de gran importancia, por cuanto extiende el concepto de zona marítimo terrestre a porciones del territorio nacional que puede encontrarse a kilómetros de la costa, de manera que los terrenos aledaños al manglar no pueden ser objeto de posesión legítima. En atención a la importancia ecológica de los manglares, es que el artículo 44 de la Ley Forestal, en concordancia con el 17 de la Ley Orgánica del Ambiente, exigen al Ministerio de Ambiente y Energía la realización del respectivo estudio de impacto ambiental, previo al otorgamiento de cualquier permiso para su aprovechamiento; y, las islas, islotes y peñascos marítimos y los terrenos y rocas que el mar deje al descubierto en la marea baja, conforme a lo dispuesto en el párrafo segundo del artículo 9 de la Ley número 6043), condición que ya había sido otorgada desde en la Ley de Aguas, número 276, de veintisiete de agosto de mil novecientos cuarenta y dos en su artículo 75, al consignar: "Son propiedad del Estado las islas ya formadas o que se formen en la zona marítimo terrestre o en la parte navegable de los ríos y en las rías y desembocadura"; y que mantuvo el Decreto-Ley número 11, de veintisiete de julio de mil novecientos cuarenta y ocho, reformado por el número 803, de dos de noviembre del siguiente año en los siguientes términos: "confirma y proclama la Soberanía Nacional sobre toda la plataforma submarina o zócalo continental e insular adyacente a las costas continentales e insulares del territorio nacional, cualquiera que sea la profundidad a que éste se encuentre, reafirmando el derecho inalienable de la Nación en todas las riquezas naturales que existen sobre, en o bajo dicho zócalo o plataforma"; y el inciso c) del artículo 7) de la Ley de Tierras y Colonización, número 2825, de catorce de octubre de mil novecientos sesenta y uno.

Debe aclararse que, en el caso de los peñascos, se aplica el concepto de zona pública a toda la formación natural, y en el de las islas, a los cincuenta metros contiguos a la línea de pleamar, considerándose zona restringida a los demás terrenos (artículo 10 de la Ley número 6042), salvo que exista manglar, en cuyo caso, se considera como zona pública, según lo indicado anteriormente.

VIII.Conviene recordar que la zona pública ha sido destinada para el libre uso, acceso y tránsito de todos; de manera que es nula todo permiso o concesión, así como el cobro del canon respectivo que se ubique en la zona pública de la zona marítimo terrestre (como lo resolvió en resolución administrativa número 148-2022, de las nueve horas cincuenta minutos del treinta de marzo del dos mil veintidós de la Sección Tercera del Tribunal Contencioso Administrativo), salvo aquellas que tengan un fin público, tales como "[...] la construcción de plantas industriales, instalaciones de pesca deportiva o artesanales, de obras portuarias, programas de maricultura, u otros establecimientos o instalaciones similares, ..." (artículo 18 de la Ley 6043); cuya ubicación cerca del mar es indispensable para su debido funcionamiento. En todo caso, deben contar con las debidas autorizaciones del MOPT, INVU, ICT y la respectiva municipalidad, atendiendo, en todo caso y en todo momento, "[...] al uso público a que se destinen, o que se trate del establecimiento y operación de instalaciones turísticas estatales de notoria conveniencia para el país" (párrafo primero del artículo 22 de la Ley de la Zona Marítimo Terrestre).

Asimismo, tratándose del recurso natural contenido en la zona pública, se advierte que tampoco se puede explotar la flora y la fauna, cortar árboles o extraer productos de la costa, si no es con la debida autorización -permiso o concesión-, en este caso, de la Dirección de Vida Silvestre, del Ministerio de Ambiente y Energía, previo estudio de impacto ambiental, al tenor de lo dispuesto en el artículo 17 de la Ley Orgánica del Ambiente. Además, corresponde a las respectivas municipalidades el facilitamiento del acceso de las playas para el disfrute y tránsito de las personas, de manera que el gobierno local debe impedir cualquier acción limitativa que impida este libre acceso a las playas. Esta labor de fiscalización también concierne al desalojo de los invasores, e incluso, de destruir o demoler las construcciones, instalaciones u obras realizadas, ya sea que se trate de simples cercas, tugurios, puestos de venta, o casas de habitación, sin responsabilidad alguna (como lo consideró el Tribunal Contencioso Administrativo, Sección Tercera en resolución número 7900-98).

Conforme al artículo 39 de la Ley de la Zona Marítimo Terrestre, sólo es posible otorgarse concesiones en la zona restringida de la zona marítimo terrestre, a cargo de las municipalidades (artículo 40 de la citada Ley); salvo en los supuestos en que exista un área silvestre protegida -reservas forestales, zonas protectoras, parques nacionales reservas biológicas, refugios nacionales de vida silvestre, humedales, monumentos naturales- que conforme a los artículo 32 de la Ley Orgánica del Ambiente y 73 de la Ley de la Zona Marítimo Terrestre, están bajo la administración del Ministerio de Ambiente y Energía.

IX. SOBRE EL CASO CONCRETO

Analizados los autos, encuentra esta Cámara que la demanda incoada resulta improcedente y debe ser desestimada, por las razones que a continuación procedemos analizar. Conforme fue planteada la demanda y las conclusiones realizadas en la audiencia de juicio oral y público, las argumentaciones de la parte actora se centran en que el señor Cruz Zeledón ha ejercido sobre el terreno objeto de este proceso la posesión requerida para usucapir de conformidad con los artículos 853 a 864 del Código Civil. De la prueba aportada en el expediente (ver hecho 03 probado de esta sentencia) efectivamente el accionante ha ejercido acciones de posesión sobre el terreno descrito en el plano sin catastrar confeccionado en enero del 2020 por el profesional en topografía Wilbert Acuña Acuña con un área de 1207 metros cuadrado, desde el año 1998, cuando adquirió la finca que colinda al norte con este terreno, que se encuentra inscrito en el partido de Puntarenas, al tomo mil quinientos once, folio cuatrocientos cuarenta y cinco, número diez mil setecientos cuarenta y siete, asiento tres.

Sin embargo, y conforme a las probanzas aportadas al expediente, es también cierto que el inmueble que se pretende que se acredite que es el titular del mismo en este proceso se encuentra en la zona marítimo terrestre, como se puede observar en el plano sin catastrar de reiterada cita y además, quedar demostrado que es un bien que se encuentra ubicado en las demasías de los terrenos que fueron vendidos por el Instituto Costarricense de Turismo en la franja marítimo terrestre comprendido entre Chacarita y la desembocadura del río Barranca (ver hecho probado 02 de esta sentencia). Así las cosas, se puede establecer que el terreno objeto de estudio se encuentra en la zona marítimo terrestre, por lo que se puede señalar que es un bien demanial, de conformidad con lo establecido en el artículo 01 de la Ley N° 6043, Ley sobre la Zona Marítimo Terrestre y lo indicado en el considerando anterior.

Así las cosas, dicho terreno posee regulaciones especiales, por lo cual no es procedente aplicar la normativa que aplica para el resto de los bienes inmuebles, específicamente lo que regula el Código Civil para adquirir un bien por prescripción positiva, como lo pretende el accionante. Esto porque, además, resulta improcedente y abiertamente contrario a la normativa que rige la materia, reconocer algún derecho de propiedad o de sus atributos (posesión, usufructo, transformación y enajenación, defensa y exclusión, restitución e indemnización, según el artículo 264 del Código Civil) al actor, por la naturaleza jurídica del bien de que se trata, al extraerse del comercio de los hombres (inalienabilidad), por lo que tampoco es posible su adquisición o pérdida mediante el procedimiento de la posesión decenal-usucapión. Por ello, en atención a que, según se explicó anteriormente, la zona que se encuentra el terreno tiene la condición de demanialidad, desde la época de la colonia, por lo que no podría otorgarse ningún título de propiedad por posesión del mismo, como se pretende.

No obstante, debe advertirse que la única salvedad a dicha regulación es cuando por disposición legal se permita obtener algún tipo de disposición para utilizar de manera privada la zona marítimo terrestre. En este sentido, lo señalado por este Tribunal al exponer:

“V.- …la afectación legal que impera sobre la zona marítimo terrestre, como zona de calificación demanial especial, conlleva indefectiblemente a estimar con lugar las alegaciones que contiene la acción del Estado, por sustentar jurídica y materialmente la base de su demanda, esto por ubicar técnicamente a los inmuebles de manera catastral en sobreposición con el área restringida de la zona marítimo terrestre…Estos bienes de dominio público se caracterizan por ser inalienables, imprescriptibles e inembargables, en consecuencia fuera del comercio de los hombres. Esto es, contra el título de demanialidad existente de conformidad con la normativa de cita, no corre oponibilidad de mejor derecho o bien, de adquisición de buena fe, ya que por dominio público se entiende el conjunto de bienes sujeto a un régimen jurídico especial, intenso y distinto al que rige el dominio privado, que además de pertenecer o estar bajo la administración de personas jurídicas públicas, están afectados o destinados a fines de utilidad pública y que no pertenecen ni pueden pertenecer (salvo desafectación legal) individualmente a los particulares…”.

Así, los bienes demaniales sólo pueden desafectarse o reducirse a dominio particular por un acto normativo de igual jerarquía, es decir por ley (Código Civil, artículos 261 y 262; votos constitucionales 5026-97, 7294-98, 2988-99, 11346-06, 2408-07, 11155-07, 13367-12, 10158-13; Sala Primera 230-90 y 189-11; Tribunal Contencioso Administrativo, votos 7747-1985-I, 9172-1987-I, 190-12-II, 84-14-II, 46-09-IX), siendo improcedente la vía reglamentaria, la resolución judicial o la actuación administrativa. (ver voto número 69-2018-II de las ocho horas treinta minutos del treinta de octubre del dos mil dieciocho) Así las cosas, los bienes que se encuentran ubicados en la zona marítimo terrestre son de dominio público por lo que se caracterizan por ser inalienables, imprescriptibles e inembargables, en consecuencia, se encuentran fuera del comercio de los hombres. Y la única forma de que pueda darse algún tipo de derecho sobre ellos es por una excepción que establezca una norma legal.

Entre las excepciones legales podemos señalar que para aquellas personas físicas, que, sin reunir la condición de pobladores - que tenían un lote en la milla marítima antes de la promulgación de la Ley de la zona marítimo terrestre, sea, antes de mil novecientos setenta y siete, y por un plazo mayor de diez años- hayan ocupado la zona marítimo terrestre, aún de forma no autorizada, con antelación a la vigencia de la Ley de la zona marítimo terrestre, en virtud de lo cual, no ostentan permiso alguno, sujetos respecto de los cuales la misma Ley sobre la Zona Marítimo- Terrestre, número 6043, en sus artículos 44, 70 y Transitorio VII, se constituyen dos de esas excepciones a los parámetros de utilización privada en la zona marítimo terrestre, y respecto de los cuales sí resulta legítimo el otorgamiento de los permisos de uso, que tiene especiales condiciones, en tanto sólo se admite "[...] para aquellos casos en que no se afecten las condiciones de la zona, ni entorpezcan el libre aprovechamiento de la zona pública y que su ejecución no limite en absoluto la futura implementación del Plan Regulador.

(Artículo 19 de la Ley 6043)." (Resolución número 10163-99, de la Sección Tercera del Tribunal Contencioso Administrativo); y que permite a las municipalidades el cobro de un cano. Pero que, en modo alguno se debe tener como el reconocimiento del derecho de posesión de tales áreas, sino únicamente como un derecho de prioridad para el otorgamiento de futuras concesiones, una vez que haya sido aprobado el respectivo plan regulador costero; de donde, en igualdad de condiciones, la administración debe preferir otorgar la concesión a quien haya poseído en forma quieta, pública y pacíficamente en forma continua, lo que denota la sujeción a la normativa territorial.

Pero las anteriores excepciones tampoco pueden ser aplicadas en el caso concreto, debido a que el actor no tiene la posesión del terreno con fecha anterior a la entrada en vigencia de dicha ley, sino a partir de 1998 (ver hechos probados 01 y 03 de esta sentencia) y no está solicitando que se le tenga como ocupante, ni que se le otorgue algún tipo de concesión. Además, indicar que esta posesión tampoco genera algún tipo de derecho de propiedad como se pretende, sino únicamente prioridad en caso de que se solicite una futura concesión.

Adicionalmente, la Ley sobre la Zona Marítimo Terrestre otorga otra excepción para la zona específica en que se encuentra el terreno que nos ocupa, al establecer en el artículo 76 lo siguiente: “Artículo 76.- Se autoriza a la Municipalidad del cantón central de Puntarenas para que venda a los ocupantes actuales, o en su defecto, a quienes pueda interesar, las demasías de los terrenos vendidos por el Instituto Costarricense de Turismo en la franja marítimo terrestre comprendida entre Chacarita y la desembocadura del río Barranca, previo avalúo que de tales demasías hará la Dirección General de la Tributación Directa. El producto de dichas ventas los destinará la Municipalidad a obras de saneamiento de las poblaciones ubicadas al Este de La Angostura. / La Municipalidad reservará una zona no menor de cincuenta metros de ancho a partir de la pleamar ordinaria que dedicará a la construcción de una alameda, cuya planificación hará conjuntamente con el Instituto Costarricense de Turismo. / Queda así reformado lo dispuesto en el artículo 2º de la ley Nº 4071 de 22 de enero de 1968. / Igualmente, reservará una zona no menor de cincuenta metros de ancho (50 m) a partir de la pleamar ordinaria, que dedicará a la construcción de la sección de la carretera panorámica comprendida entre "La Vuelta", ubicada en el distrito doce, Chacarita, y las inmediaciones del "Yacht Club", en el distrito primero, Puntarenas; la cual, por tratarse de una ruta de la red vial nacional estará a cargo del Ministerio de Obras Públicas y Transportes (MOPT) y su conservación vial a cargo del Consejo Nacional de Vialidad (Conavi).” Así las cosas, según lo indicado en el artículo anterior, la única posibilidad para que el terreno pueda ser desafectado y pueda ser propiedad de un particular es que la Municipalidad de Puntarenas, cumpliendo primeramente con los requisitos establecidos en dicho artículo y respetando las restricciones señaladas, decida, según sus potestades, vender dicho terreno al actor, al ser éste el que ocupa en este momento el terreno.

En consecuencia de todo lo indicado, las características propias del régimen jurídico de ese tipo de bienes (demaniales) hace que en virtud de la mencionada inalienabilidad, sea inviable por este medio conceder al particular, en este caso, accionante, un derecho de titulación sobre el terreno que dice haber poseído u ocupado (con independencia del plazo de más de veinte años que alega), como tampoco sería factible declarar a su favor un derecho de posesión o mejor derecho posesorio que le permita beneficiarse o usufructuar de manera privativa de esa franja litoral. Al margen de los actos posesorios que el actor haya alegado ejercitar sobre el terreno, tal aspecto no podría dar paso al nacimiento de un derecho de titulación o de inscripción a su nombre de zonas que por sus características se ha determinado que componen parte del dominio público, ni a tenerles, como pretenden, como propietarios de esas fincas, salvo por el procedimiento establecido en el artículo 76 citado.

Debe indicarse, en este tipo de cosas públicas, las proyecciones de su marco jurídico impide la figura de la usucapión o prescripción adquisitiva, lo que deriva de su imprescriptibilidad, ergo, el decurso del tiempo en su aprovechamiento (o posesión), no constituye base para apropiarse del bien. De ahí que la pretensión de que se declare como propietario del terreno objeto de este proceso, no encuentra respaldo ni amparo en el ordenamiento normativo, según lo estatuye el ordinal 7 de la Ley No. 6043, Ley sobre la Zona Marítimo Terrestre. Lo anterior implica, desde la óptica del sujeto privado, una imposibilidad jurídica de adquirir la propiedad en virtud del instituto de la usucapión, y consecuentemente, la Administración Pública nunca perderá la titularidad y administración que sobre estos ejerce, hasta tanto no ocurra una desafectación, por lo que debe rechazarse esta pretensión.

En cuanto a la segunda pretensión planteada por la parte accionante mediante la cual pretende el pago de las mejoras que se han introducido al mencionado terreno, al cuido que ha dado a éste, a la plusvalía que su posesión, cuido, y mejoras han producido en el terreno de marras, la misma debe ser rechazada. En primer lugar, el actor no argumentó ni demostró poseer un justo título para ejercer los actos posesorios que legitimarán la ocupación que realizaba en un terreno que era de dominio público y que esta posesión fuera de buena fe o legitima sobre la parcela, de conformidad con los términos establecidos en el artículo 154 de la Ley General de la Administración, por lo que no sería procedente algún tipo de indemnización por mejoras realizadas. Adicionalmente, sobre la base de la prueba recabada no es posible ubicar la existencia de mejoras que deban cancelarse. Es de recordar sobre el particular que sobre la base del canon 41.1 del Código Procesal Civil corresponde a la parte interesada acreditar su dicho, máxime frente a una gestión civil de hacienda, lo que en este caso no se encuentra satisfecho.

No existe ninguna prueba de las mejoras que se alegan, no se presentaron fotos, recibos de gastos o alguna otra prueba pertinente. La única prueba es la testimonial, específicamente lo manifestado por los señores Miguel Jiménez Cordero y Róger Cruz Zeledón, de la cual, lo único que se puede extraer es que existe una cerca y zona verde pero no se puede delimitar si se trata de la propiedad que adquirió el accionante o del terreno que nos ocupa, no siendo concluyente dicha prueba. Por lo que este órgano jurisdiccional carece de elementos de convicción para demostrar la existencia de algún importe a su favor. Así las cosas, ante la ausencia de prueba oportuna sobre el particular impiden tomar una decisión contraria, lo que lleva al rechazo de esa pretensión sin mayores cuestionamientos.

X. EXCEPCIONES

La Municipalidad de Puntarenas interpuso las defensas de falta de legitimación activa y pasiva, así como la de falta de derecho. En cuanto a la legitimación activa, el accionante muestra una evidente conexidad con el objeto del proceso, en la medida que se busca la tutela de lo que considera, es un derecho subjetivo einterés legítimo a obtener la titulación por haber poseído por más de 10 años el terreno que ocupa, así como al derecho de obtener reparación patrimonial por la mejoras introducidas. Así tal nexo se sustenta en el contexto del numeral 10 inciso primero, numeral a) del Código Procesal Contencioso Administrativo, razón por la cual, la defensa de falta de legitimación activa ha de ser rechazada. En cuanto a la excepción de falta de derecho formulada, la misma debe acogerse, según la normativa citada y los fundamentos de hecho expuestos, al no asistirle el derecho invocado al actor en sustento de sus pretensiones, sino que por el contrario debe denegarse la acción incoada al no poder otorgarse ningún título de propiedad por posesión como se pretende lo que hace improcedente las pretensiones solicitadas. Así las cosas, procede rechazar la demanda en todos sus extremos.

XI. COSTAS

Conforme a lo regulado en el artículo 193 del Código Procesal Contencioso Administrativo, las costas personales y procesales constituyen una carga que se impone a la parte vencida por el hecho de serlo y sólo procede su dispensa cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar, o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En el caso de estudio, no encuentra este órgano colegiado motivo para aplicar las excepciones que fija la normativa aplicable y quebrar el postulado de condena al vencido. Por ende, se imponen ambas costas al señor JOSÉ ENRIQUE CRUZ ZELEDÓN más los intereses que se han de calcular desde que se fijen las costas en firme hasta su efectivo pago, al tipo legal que establece el artículo 1163 del Código Civil. Se dispone que estos extremos se determinarán y liquidarán en fase de ejecución de sentencia, una vez firme este pronunciamiento.

POR TANTO

Se rechaza la excepción de falta de legitimación ad causam activa y se acoge la excepción de falta de derecho interpuestas por la representación de la Municipalidad de Puntarenas. En consecuencia, se declara sin lugar la demanda en todos sus extremos. Se imponen ambas costas al señor JOSÉ ENRIQUE CRUZ ZELEDÓN más los intereses que se han de calcular desde que se fijen las costas en firme hasta su efectivo pago, al tipo legal que establece el artículo 1163 del Código Civil. Se dispone que estos extremos se determinarán y liquidarán en fase de ejecución de sentencia, una vez firme este pronunciamiento. ES TODO.
