Judge Córdoba Ramírez authors the judgment, which is decided unanimously.-
CONSIDERING
I.Regarding the evidence offered for further consideration (prueba para mejor resolver). By way of evidence for further consideration, the municipal representation requested, in a written submission filed with the court on 13 de enero del 2020, the following: “1. Certified copy of water analyses issued by the Instituto Nacional de Acueductos y Alcantarillados, as well as by the Escuela de Ciencias Ambientales de la Universidad Nacional de Costa Rica; 2. Certified copy of the commencement of work for the installation of metering equipment for the Municipal Aqueduct; 3. Certified copy of the commencement of work for the installation of metering equipment for the Municipal Aqueduct; 4. Certified copy of the case file for Abbreviated Tender (Licitación Abreviada) N° 2019LA-00004-CL, ‘Maintenance and supplementary works (Public Works) at the tanks and springs (nacientes) of the Cantón de Santa Bárbara’; 5.
Certified copy of the case file for Licitación Abreviada N° 2019-LA00005-CL, ‘Waterproofing of drinking-water storage tanks’; 6. Certified copy of the Update to the Municipal Aqueduct Master Plan.” Subsequently, through another written submission, this time filed with the court outside working hours on the day before the supplementary hearing was held, namely, 09 de enero del 2024, a request was made for the admission, in the same capacity, of a vast quantity of documentation that was explained during that oral hearing and is intended to demonstrate the current state of affairs concerning the aqueduct at issue. It comprises 263 images from the court case file, and because of the extensive volume of documents, we will not specify them individually. In addition, the testimony of the individuals identified as Mr. David Cortés Sánchez and Harold Chaves Montero, as this Court understands it, was also offered as evidence for further consideration, for the same purpose as the preceding documentary evidence (prueba documental).
The parties were informed that the corresponding ruling on its admissibility, if it were to be rejected, would be made in the judgment. In this regard, it bears recalling that, with respect to documentary evidence for further consideration, the provisions of Article 50 of the Código Procesal Contencioso Administrativo are indeed mandatorily applicable. Furthermore, it is also relevant to note that, under the currently applicable text of the Código Procesal Civil, the legislature unfortunately omitted to regulate this mechanism of evidence for further consideration, whereas Article 331 of the repealed version of that body of law adequately and clearly governed the matter. In the currently applicable Código Procesal Civil, the only relevant regulation concerns the admission of evidence on the court’s own motion (prueba oficiosa), pursuant to Article 41.3., which could of course be—and, in fact, in some cases will be—evidence for further consideration.
In any event, we consider that it must be borne in mind that, under either body of law, evidence for further consideration belongs to the Judge and not to the parties, regardless of whether or not they offer it; therefore, its rejection should not, through any sort of rational automatism, result in denial of the right of defense (indefensión) and, consequently, in a substantial defect arising from such denial. (Sala Primera de la Corte Suprema de Justicia N° 547-F-2002 de las 16:00 hrs. del 12 de julio de 2002; N° 29-1995 de las 15:30 hrs. del 22 de febrero de 1995; N° 290-F-S1-2009 de las 10:30 hrs. del 20 de marzo de 2009). On the other hand, whether or not to order evidence of this kind entails certain limits on the adjudicator, in the sense that this mechanism must not be used to discharge a procedural duty that falls solely upon the claimant or defendant, namely, the duty to offer the evidence relevant to that party at the appropriate procedural stage.
(Sentencia de la Sala Primera N° 001439-F-S1-2014 de las 09:25 horas del 07 de noviembre de 2014). Accordingly, in the Judge’s pursuit of substantive truth (verdad real), the Judge may not—at the risk of violating other principles of equal procedural rank or hierarchy that must remain in balance—order evidence for further consideration when doing so would inevitably replace the ordinary defense mechanisms available to those bound by the procedural legal relationship (relación jurídico procesal) and required to prove their claims or defenses by virtue of their position within that procedural relationship. Except in extremely rare and exceptional circumstances that must be duly substantiated and reasoned, as well as supported by overriding interests—particularly in cases involving qualified public interests or public interests afforded enhanced protection because of their importance—the contrary approach could readily prompt questions as to whether the Judge’s conduct complies with the duty to remain objective and impartial while preserving the procedural balance between the parties.
It would also amount to inadmissible assistance in favor of a party who, through negligence, carelessness, or an intention to obtain an improper procedural advantage by exercising its right abusively and/or antisocially, failed to exercise properly and/or timely its right and duty to present evidence and now seeks by that means to remedy a procedural omission that it alone was responsible for preventing when it should have done so. (See Articles 21 and 22 of the Código Civil and the ruling of the Sala Primera in its judgment N° 794-2006 de las 03:35 hrs. del 20 de octubre de 2006, which states, insofar as relevant: “... Furthermore, it must be noted that it is inappropriate to attempt to reopen the debate by offering evidence that should have been submitted and taken at the corresponding procedural stage. Granting this request would mean allowing the parties to remedy their omissions regarding evidence that they could have offered at the proper time but did not.
Nor is it possible to permit the expansion of the testimony of two witnesses, because doing so would likewise correct their own lack of diligence”). It also bears recalling that some legal scholars insist that the Judge must proceed “(...) with the utmost caution, because there is no doubt that a measure carried out under those conditions may invariably prejudice a right that would otherwise have benefited from the defective development of the evidentiary record, and it is therefore necessary to ensure that the Judge’s impartiality is not compromised, taking care that at no time may the Judge be deemed to have intended to make up for the negligence of any of the parties” (Alsina. Hugo (1956). Tratado Teórico Práctico de Derecho Procesal Civil y Comercial. Tomo I. Buenos Aires, p. 445). In light of all the foregoing, because this Chamber considers only the evidence identified below to be necessary, given the terms on which this matter is to be decided, exclusively the following is admitted: first, all of the evidence offered in the written submission filed with the court on 13 de enero del 2020.
The remaining evidence—namely, the entirety of the documentary evidence offered in the written submission filed on 09 de enero del 2024 and the testimony of Mr. David Cortés Sánchez and Harold Chaves Montero—is rejected as unnecessary by this Court.-
II.Regarding the objections raised by the plaintiff. In support of its action, the plaintiff stated the following: “First. The Association I represent owns the property registered in the National Registry, Heredia District, property number 146587-000, which was acquired because of its social importance, insofar as it contains the water springs (nacientes de agua) of the district of El Roble de Santa Bárbara, province of Heredia, known as the Amapola springs, which supply approximately 896 homes and a population of nearly 2754 inhabitants. Evidence. A certification for the Heredia property number 146587-000 (RNPDIGITAL-10077384-2018) is attached. (...). Second. All the water distribution and storage infrastructure was built by the residents of the district of El Roble, who also assumed responsibility for administering the water supply system (acueducto). Nevertheless, approximately 20 years ago, the Municipalidad de Santa Bárbara assumed the direction and governance of that system, without any transfer of the property identified in the preceding fact.
(...). Third. During the period from the municipality’s assumption of the water supply system to the present, the service provided has become deplorable, because all planned investment needed to adapt the service to the growth and needs of the user population has been omitted; all of which we set forth in the following facts. (...). Fourth. Memorandum OPT-EYP-00-335 of 20 de octubre de 2000, circulated among departments of the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, attached the document entitled Evaluación Acueducto del Roble de Santo Domingo, Santa Bárbara de Heredia, which, as stated therein, was prepared because a group of residents of El Roble appeared before the Executive Office of that Institute to request intervention in the water supply system, since they believed ‘that the Municipality does not properly attend to it and that both the maintenance and the water quality are deplorable.’ This assessment concludes that several infrastructure projects are necessary, including replacement of the pipes, which has not been carried out to date.
(...). Fifth. As recorded in official letter UPC-CAH-01507-01 of 30 de octubre de 2001, from the Proceso de Control del Ambiente Humano to the Dirección de Central Norte - Heredia, both departments of the Ministerio de Salud: ‘Our Proceso de Control al Ambiente and the Área de Salud de Santa Bárbara jointly conducted point sampling to verify the bacteriological and sanitary quality of drinking water. Two points tested positive for fecal coliforms (sources and network).’ (...). Sixth. This latter document also recommends that the Concejo Municipal de Santa Bárbara carry out ‘the transfer of the water supply system, taking into consideration Articles: 2, 3 and 4.1, Chapter 1 of the Reglamento de las Asociaciones Administradoras de los Servicios de Acueductos y Alcantarillados (Decreto 29100-S).’ (...). Seventh. Official letter UPC-CAH-AMM-796-03 of 06 de noviembre de 2003 from the UNIDAD DE PERMISOS Y CONTROLES of the Ministerio de Salud states: ‘The result of the sanitary bacteriological analysis reveals: / El Roble: Supplied by La Amapola, with an average density of Fecal Coliforms at the sampling points.’ (...).
Eighth. On 16 de noviembre de 2011, the Área Rectora de Salud de Santa Bárbara issued health order (orden sanitaria) 105-2011, once again addressing an issue that had repeatedly gone uncorrected in the past, namely, the distance or setback between homes and the springs. (...). Ninth. Official letter CN-ARS-SB-1011-2012 of 05 de julio de 2012 from the ÁREA RECTORA DE SALUD SANTA BÁBARA of the Ministerio de Salud states, after noting several instances of noncompliance: ‘Based on the inspection conducted at the spring and the storage tank of the Santo Domingo del Roble water supply system, maintenance and monitoring must be performed at the springs in accordance with existing regulations. The necessary work must be carried out around the spring and continued, including perimeter protection to prevent unauthorized persons from entering the water intake areas and the construction of drainage ditches to prevent surface water from entering the collection tanks. / A general cleaning of the spring is essential, and steps must be taken before the appropriate authority to expand the spring’s protection area.
Secure locking systems must be installed on the covers using padlocks or other, more secure devices.’ Health order N° 51 -2012 was also issued. (...). Tenth. By official letter DAC-MSB-548-2012 of 27 de julio de 2012, the engineer responsible for the municipal water supply system informed the Alcaldía de Bárbara that the cleaning work ordered in the preceding fact had been completed, but that, with regard ‘to the care of the spring, I hereby inform you that, depending on the extraordinary budget, we will do everything possible to include the Naciente Amapola on the list for “Mejoras de las Nacientes,” since we have several water intakes that are in deplorable condition and urgently require maintenance using the extraordinary-budget funds, which are insufficient for so many springs.’ (...). Eleventh. Official letter CN – ARS – SB – 638 – 2013 of 13 de mayo del 2013, a document following up on health order 51-2012, records noncompliance with that order and, generally, the lack of maintenance of the water supply system.
The document states that a criminal complaint will be filed. (...). Twelfth. Official letter CN–ARS–SB–902–2013 of 24 de junio del 2013 from the ÁREA RECTORA DE SALUD DE SANTA BÁRBARA to the DIRECCIÓN REGIONAL DE RECTORÍA DE LA SALUD CENTRAL NORTE, both departments of the Ministerio de Salud, states: ‘The inspection conducted revealed noncompliance with issued health order N° 51–2012, including irregularities in perimeter protection and maintenance of the water supply systems.’ (...). Thirteenth. Given the seriousness of the situation involving the water supply system and the evidence accumulated over so many years, the entity I represent, the ASOCIACIÓN DE DESARROLLO INTEGRAL DEL ROBLE DE SANTA BARBARA DE HEREDIA, asked Ingenieros Consultores y Ejecutores de Acueductos S.A. to prepare a study of the El Roble water supply system. The study was submitted by Engineer Fernando Sánchez Redondo, code IC 5002, who reached the following conclusion on 12 de julio de 2013: ‘The inspected system has largely collapsed from a technical, sanitary, and operational standpoint, to the detriment of the entire community of El Roble de Santa Bárbara, and therefore requires immediate and urgent attention.’ (...).
Fourteenth. In official letter CN-ARS-SB 1115-2014 of 26 de agosto del 2014, the DIRECCIÓN ÁREA RECTORA DE SALUD DE SANTA BÁRBARA filed an environmental-pollution complaint with the Fiscalía de Flores against the head of the defendant Municipality because instances of noncompliance were again found on 14 de mayo de 2014, placing the water quality of the La Amapola water supply system at risk, and because of noncompliance with health order 10-2014 of 20 de mayo de 2014. (...). Fifteenth. In an official letter dated 11 de febrero de 2016, the then Mayor of the defendant Municipality, Mr. Melvin Alfaro Salas, submitted a proposal to the defendant Institute requesting that it intervene in this community’s water supply system. That document was endorsed by the plaintiff Association and submitted to that Institute on 22 de abril of that year. It received no response, which made it necessary to file an amparo proceeding (recurso de amparo), resulting in the favorable judgment 2017-020135 of 9:20 hours on 15 de diciembre de 2017, which ordered that ‘the relevant studies be be conducted to guarantee the water quality of the reported water supply system and that a decision be issued on the request for intervention in the water supply system filed by the protected Association ….’ (...).
Sixteenth. As a result of the judgment and the administrative actions taken by the plaintiff Association, the defendant Institute proceeded to outline an initial attempt to work toward that end, which ultimately proved fruitless because of both the position of the defendant Municipal Corporation and the failure of the governing body to act. (...). Seventeenth. At that same time, Mayor Melvin Salas authorized the delivery to the plaintiff Association of six- and four-inch pipes to replace the asbestos-cement pipe extending for approximately 800 meters within the water distribution network. The plaintiff Association transported and installed those pipes, bearing all costs; however, approximately 5 or six six-inch pipes were still needed to complete the replacement of the asbestos-cement pipe. Requests were made to the Municipality on numerous occasions to connect that pipeline, without success.
The new pipeline has now been buried and unused for almost three years. (...). Eighteenth. Official letter CN-ARS-SB-241-2017 of 3 de marzo del 2017 from the DIRECCIÓN ÁREA RECTORA DE SALUD SANTA BÁRBARA analyzes the results of Report AG-765-2016 concerning the water quality of 30 systems administered by the Municipalidad de Santa Bárbara. Deficiencies were found in all of them, and the Amapola water supply system was classified as Very High Risk because fecal coliforms and E. Coli were detected in the storage tank or Network, and the residual chlorine did not reach adequate disinfection levels or was not detected. Health order N° 242-2017 was also issued. (...). Nineteenth. By judgment 2017009566 of the Sala Constitucional, issued at 9.45 hours on 23 de junio de 2017, the amparo against the defendant Municipality was granted because of its noncompliance with the health order just identified and also its noncompliance with order 497-2017.
(...). Twentieth. In official letter CN-ARS-SB-986-2017 of 29 de setiembre del 2017 from the DIRECCIÓN ÁREA RECTORA DE SALUD SANTA BÁRBARA of the Ministerio de Salud, issued in compliance with the judgment cited in the preceding fact and health order 242-2017, it was found that the latter had been partially complied with. (...). Twenty-first. In official letter CN-ARS-SB-1241-2017 of 16 de noviembre del 2017 from the DIRECCIÓN ÁREA RECTORA DE SALUD SANTA BÁRBARA of the Ministerio de Salud, which analyzes the sampling report for 23 springs corresponding to 17 water supply systems in the canton, it again concludes that the system must be classified as High Risk and states: ‘The supply system’ (...). Twenty-fourth.
That, in compliance with Health Order N° 236-2018, the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS prepared a report on all the water-supply systems operated by the respondent Municipality, identifying all their deficiencies, their legal status, the work that must be performed, construction plans for that work, and the need for the respondent to prepare work schedules. Among other omissions, that report found fecal coliforms in this community’s water-supply system. It also states: “As for the collection tanks for the springs (nacientes) and the Amapola storage tank, they lack water chlorination, maintenance, cleaning, and access to the tanks; they have neither warning signs nor perimeter security.” (...). Twenty-fifth. That, in following up on and corroborating the situation assessed at the request of my client, as indicated in preceding fact 13, Ingenieros Consultores y Ejecutores de Acueductos S.A. was again asked to prepare an updated study of the El Roble water-supply system.
That study was again submitted by Engineer Fernando Sánchez Redondo, code IC 5002, who reached the following conclusion on 07 de marzo de 2019: “In summary, as a consultant, I consider that this system as a whole has a series of structural and sanitary weaknesses and fails to comply with the standards established for the supply of drinking water, to the detriment of and at risk to the health and quality of life of the community of El Roble de Santo Domingo de Santa Barbara. / I must also state that, in julio del 2013, in an initial report, I had already identified this entire series of system deficiencies, and practically six years later, the same problems persist in the operation of the water-supply system. This demonstrates a complete lack of attention and interest on the part of the system administrator, as well as a lack of adequate knowledge regarding the operation of a drinking-water supply system. A detailed Technical Study must urgently be conducted to establish the logical and orderly planning of improvements in stages.” (...).
The claim submitted for adjudication by the Contentious-Administrative Jurisdiction is based on the wholly inefficient provision, posing a serious danger to health, of the public drinking-water service for the community of Santo Domingo del Roble de Santa Barbara de Heredia.
A. INTRODUCTION. The water-supply system of this community of Roble de Santa Bárbara was built by its residents; everything from the spring to the distribution network was built by hand by the town’s founders. As the years passed and the population grew, it was considered more appropriate for its administration to be placed in the hands of the community’s highest authority, and it was therefore transferred to the Municipal Corporation. Even so, the residents, concerned about the future of their water sources, acquired the land on which the community’s spring is located and, through great effort, have retained title to it for many years.
For many years, the Municipality has devoted itself to resolving immediate problems, essentially repairing water leaks. In numerous individual or collective actions, the residents have brought various cases before the courts—particularly the Constitutional Chamber—seeking better service, the protection of health, and, repeatedly, intervention in that service. The Chamber, and more recently the Instituto de Acueductos y Alcantarillados, have ruled in favor of the community, as has, even more clearly, the Ministerio de Salud, which has not only indicated the need to transfer the water-supply system but has also issued numerous health orders seeking the correction of irregularities. Many of these orders have repeatedly concerned the same instances of noncompliance and deterioration, which are never finally resolved because they are addressed incorrectly.
Acueductos y Alcantarillados has also identified numerous irregularities for the respondent and explained how to correct them. It has asked the Municipality to perform planned work according to schedules and has even provided basic plans for the work that must be carried out. The Constitutional Chamber, for its part, has sought to protect the residents’ health by granting numerous writs of amparo (recursos de amparo)—those cited in the statement of facts are merely a sample—and, in particular, when it granted the action filed by the plaintiff Association, it ordered a specific ruling on the intervention sought in the proceeding. Nevertheless, none of this has produced results.
Time and again, the Municipality denies the feasibility of transferring the water-supply system to a community water-system administrative association (ASADA), much less to the respondent Instituto; Acueductos avoids deciding on an intervention by invoking the designated use of its funds, while in reality basing its conduct on an absolute fear of conflict. The Constitutional Chamber always directs the matter to the ordinary legal process because the issue cannot be resolved in that forum.
The reality is that the situation reveals an old, deteriorated water-supply system subject to deficient administration, lacking all planning and any vision for the future, devoid of creativity, underused, and wasteful throughout its entire infrastructure. For many years, the Municipality has invoked the existence of a loan to modernize it, which is nothing more than a fiction inherited from one administration by the next. It is painful to see the rivers of water that spill whenever the main pipelines and their branches break because of their poor quality or age; the waste of water during the rainy season due to the lack of storage tanks; the deterioration of the areas surrounding the spring—including an illegal structure in the spring area that the Municipality has tolerated and failed to demolish—and, of course, the absence of any genuine policy to protect that resource and its sources.
Through the Asociación de Desarrollo, the community acquired the land containing the spring. This ownership should be extended to other surrounding areas, given the restriction that legislation imposes on land use (uso de suelo), but the lack of municipal leadership and the population’s apathy toward its mandate prevent such an extension.
Acting on the principle that deeds speak louder than words, whenever residents have been called together to address this issue, they have attended every event convened by the Association in large numbers. In this manner, several hundred meters of asbestos-cement piping were replaced with plastic piping, which is currently in use. However, the largest section, consisting of approximately 800 meters of asbestos, remains in use, even though more than three years ago the Association financed all the installation work. The replacement pipeline is there, abandoned deep underground, only a few meters from the main branch that it was intended to replace, while we residents continue consuming asbestos cement through the water.
The same storage tanks, the same metal and asbestos-cement pipelines, and the same distribution structure from more than 50 years ago continue to serve this community, despite a population that has grown by more than 1000 percent. There are no fire hydrants here. There are no shutoff valves to stop leaks from the main pipeline. There is no materials warehouse or personnel available to service the system. There are no construction or location plans for the tanks and pipelines. There is no control over illegal water connections. There is no differentiation in that service. There is no control of wastewater (aguas servidas) at the spring. There are no facilities of any kind for personnel when they work at the spring. There is zero maintenance of the spring and all branches. There is zero maintenance or identification of pipeline easements (servidumbres).
This complaint asks the adjudicators to assess the urgency that we face as a social organization and as representatives of our population’s interests in enjoying, preserving, and improving everything related to the drinking-water supply. It asks that the respondent Municipalidad de Santa Barbara return it to the legitimate stakeholders, and that the respondent Instituto assume the corresponding responsibility, either directly or through the neighboring ASADAS, so that the administration established may achieve the objective sought by our population.
B. PUBLIC DRINKING-WATER SERVICE. The Instituto Costarricense de Acueductos y Alcantarillados (AYA) is responsible for directing, setting policies, establishing and applying standards, carrying out and promoting planning, financing, and development, and resolving all matters related to the supply of drinking water (art. 1 ley 2726). The Instituto is also responsible for determining the priority, advisability, and feasibility of the various proposed projects to construct, renovate, expand, or modify water-supply and sewerage works, none of which may be carried out without its approval (art. 2 inciso b). Likewise, and of the greatest relevance to this proceeding, it is responsible for directly administering and operating water-supply and sewerage systems throughout the country, which it must gradually assume based on advisability and the availability of resources; systems currently administered and operated by municipal corporations may remain under their control for as long as they provide efficient service (art. 2 inciso g).
Reglamento 32529 de dos de febrero del 2005, entitled Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, provides that the respondent Instituto may delegate the administration, operation, maintenance, and development of community water-supply and/or sewerage systems to associations known as ASADAS (artículo tercero). The purpose of these legal entities is to construct, administer, operate, maintain, and develop the water-supply and sewerage systems delegated by the Instituto, as well as to conserve and rationally use the water necessary to supply the population (artículo 16 del reglamento 32529). If such entities fail to guarantee the public service, the Instituto may assume, by operation of law, their administration, operation, maintenance, and development, together with all their duties, obligations, and assets (artículo cuarto).
C. PRINCIPLES OF PUBLIC SERVICE. The Ley General de la Administración Pública provides in artículo 4 that the activities of “[…] public entities shall, as a whole, be subject to the fundamental principles of public service, in order to ensure their continuity, efficiency, adaptation to every change in the legal framework or in the social need they fulfill, and equal treatment of their recipients, users, or beneficiaries.” In this regard, the Constitutional Chamber has held: “IV.- On the fundamental right to the proper functioning of public services. In its case law, this Chamber has established that the Political Constitution recognizes an unnamed or atypical fundamental right: the right of persons subject to the Administration to the proper functioning of public services. This right is inferred from the relationship among provisions 140, subsection 8°, 139, subsection 4°, and 191 of the Fundamental Law, interpreted a contrario sensu, insofar as they respectively establish the deontological standards governing administrative functions, such as the ‘proper functioning of administrative services and departments,’ the ‘proper conduct of Government,’ and ‘administrative efficiency.’ Numerous judgments have already held that this fundamental right to the proper functioning of public services requires public entities to exercise their powers and provide public services efficiently and effectively and, naturally, imposes the corresponding obligation to compensate for the damages and losses caused when that constitutional guarantee is violated.” Constitutional Chamber.
Decision No. 02923 – 2011. Date of Decision: 04 de marzo de 2011. Case File: 10-016393-0007-CO. Type of Proceeding: Amparo appeal (recurso de amparo). Regulation 30413 of 25 de marzo del 2002, Sectoral Regulation for the Regulation of Water-Supply and Sanitary-Sewerage Services, entrusts the Instituto Nacional de Acueductos y Alcantarillados with planning, financing, and developing everything related to the supply of drinking water, ensuring that water-supply and sanitary-sewerage systems comply with the principles governing public services. Finally, as relevant to the present case, we emphasize that Regulation 32529 provides that all movable and immovable property used in the administration, operation, maintenance, and development of water-supply and sewerage systems is deemed to be in the public domain (dominio público) and may not be disposed of (Articles 18 and 21, subsection 10). D. FUNDAMENTAL RIGHT TO HEALTH.
The case law of the Sala Constitucional has also been consistent and reiterated regarding the fundamental right to health: “V.- The right to life recognized in Article 21 of the Constitution is the cornerstone upon which the remaining fundamental rights of the inhabitants of the Republic rest. Likewise, the right to health finds its basis in that provision of the Constitution, since life is inconceivable unless human beings are guaranteed the minimum conditions necessary for an adequate and harmonious psychological, physical, and environmental balance. Clearly, any delay by the hospitals, clinics, and other healthcare units of the Caja Costarricense del Seguro Social may adversely affect the preservation of their users’ health and lives. Public entities, bodies, and officials owe a duty to users and must demonstrate a clear and unequivocal commitment to service, since that was the reason for their creation and existence.” Sala Constitucional.
Decision No. 06574 – 2008. Date of Decision: 22 de abril del 2008. Case File: 08-004740-0007-CO. Drafted by: Gilbert Armijo Sancho. Type of Proceeding: Amparo appeal. With respect to the supply of drinking water, the case law of the Sala Constitucional has also established that it is an essential public service and that, for this same reason, it yields to the exercise of other fundamental rights (6362-96 of 20 de noviembre de 1996), and that the principles governing public services are heightened “[…] in the case of essential public services, such as access to drinking water, because the right to health is also implicated” (Judgment No. 13330 of the Sala Constitucional de la Corte Suprema de Justicia, dated 29 de Agosto de 2008). Articles from various bodies of law were cited in the section of the complaint identified as legal grounds, without setting forth arguments specifying how, in the plaintiff’s view, each provision would be directly applicable to the specific case.-
III.Regarding the defense arguments raised by counsel for the defendant Municipality. For its part, counsel for the defendant Municipality stated in opposition to the complaint that it is true that the plaintiff owns the property at issue; nevertheless, the intake (captación) and concession for the La Amapola spring (naciente) belong to the Municipality. Although the Ministry of Health made recommendations in official letter UPC-CAH-01507-01, those recommendations were made 18 years ago and do not reflect the aqueduct’s current situation; moreover, there are regulations and a procedure that must be followed for AyA to remove the Municipality from the administration of the aqueduct. Other situations described by the plaintiff date back 10, 7 or 8 years and do not reflect the current reality. The Municipal Aqueduct’s budget has been quite limited throughout all those years because it lacks what was identified as “micro-metering” (micromedición), a project that is currently about to begin; consequently, the consumption-based rate has been insufficient to cover the aqueduct’s maintenance, operation, growth, and investment.
As for the study conducted by the Association or at its request, it was financed with funds of unknown origin and carried out by persons unaffiliated with the Municipality, which is prohibited under article 45 of the Regulations for the Operation and Administration of the Santa Bárbara Municipal Aqueduct. Thus, that report is unlawful and therefore constitutes spurious evidence because it was prepared without municipal authorization or oversight, “... negligently endangering the sanitary quality of the water and the condition of municipal infrastructure, and trespassing on public property without authorization, ...”. The aqueduct is currently under intervention by AyA, which monitors the Municipality’s progress toward fulfilling its water-service supply obligations. The pipeline referred to by the plaintiff is connected and operational. Indeed, as a result of sanitary order N° 242-2017, the Municipality learned of deficiencies in 24 of the 30 aqueduct systems it owns.
Nevertheless, the Municipality has not remained inactive in the face of these circumstances, because through official letter OAMSB-180-17 it informed the Santa Bárbara Health Area of the initial actions taken pursuant to that sanitary order, indicating that it had requested land-use authorization (uso de suelo) for the processing of the aqueduct’s sanitary permit and that work had begun for the purchase and installation of chlorination equipment in the Canton’s storage tanks. This allegedly took place on 11 de enero del 2017, and it was also reported that the Universidad Nacional would be responsible for monitoring chlorination and identifying the springs and tanks to be addressed during an initial phase. Finally, information was provided through a table of the systems that comply with residual chlorine measurements under Decreto Ejecutivo N° 38924-S. Indeed, the Sala Constitucional ruled against the Municipality for failure to comply with sanitary order N° 242-2017, but the plaintiff fails to mention that the order establishes a number of requirements, including requesting land-use authorization and a sanitary permit, submitting a compliance schedule, and submitting an assessment of the conveyance network, for which the Municipality was given periods of 1 month, 3 months and 6 months to resolve problems arising from more than 50 years of neglect of the Municipal aqueduct.
It stated: “The Municipality has indeed experienced problems complying with order 242-2017; however, the Ministry of Health has sought to require the Municipal Administration to comply with everything requested without taking into account the proportionality and reasonableness of the case, bearing in mind that no one is required to do the impossible. The Municipality began work on and expansion of the Municipal Aqueduct, whose annual budget is approximately 55 million per year, which is manifestly insufficient; consequently, the Municipality has had to invest funds from other accounts in order to comply with the Ministry of Health’s requirements. It should be noted that the municipal aqueduct currently lacks micro-metering, insofar as the corresponding public tender is being conducted through a loan from the Instituto de Asesoría y Fomento Municipal, which took two years to receive endorsement from the Contraloría General de la República, and it was not until julio del año en curso that the oversight body granted its endorsement.
For that reason, the Municipality has a fixed fee of approximately four thousand colones per month, which is insufficient for the administration, maintenance, and investment needs of the Municipal aqueduct. This is detrimental to the service and causes the service subscribers themselves, because they are not charged based on consumption, to use (sic) the water service indiscriminately, since the fee charged will always be the same.” Regarding allegation 26 of the complaint: “... although some of what the plaintiff alleges is true, as indicated in several of the allegations, it does not reflect the current situation of the municipal aqueduct, because on 27 de mayo del 2019 municipal officials, the mayor (...) and members of the Municipal Council met with AyA personnel and the Executive President (...) in order to review compliance with the 1er and 1ndo progress reports concerning the technical report on the Santa Bárbara municipal aqueduct (PRE-2018-01135 Y PRE-2018-01228), which arise in connection with Ministry of Health sanitary order 236-2018.
At that meeting, the results were unsatisfactory to the Institute, and it informed us that, due to that situation, steps would be taken to reassume control of the municipal aqueduct; however, this resulted from the limited compilation of information regarding the actions carried out by the municipal aqueduct staff. Due to the heavy workload, no effective channel for transmitting information was established between the municipal corporation and AyA. (...). In light of the foregoing, the Municipality decided to establish a municipal aqueduct assistance committee through Municipal Mayor’s Office administrative resolution 127-2019. Accordingly, on 30 de mayo del 2019, through official letter PRE-UTSAPS-2019-00073, Ms. Zaida Ulate Gutiérrez of AyA’s Unidad técnica de Servicios de Abastecimiento de Agua Potable y Saneamiento stated that Institute personnel would travel to the Municipality on 04 de junio del 2019 to request all documentation necessary to verify the level of compliance with the aforementioned reports.
In response, the Municipal Mayor informed them through official letter OAMSB-233-19 that those officials would be received by the committee responsible for addressing the matter. (...). That committee (...) devoted considerable effort to preparing a report that was submitted to AyA, the Sala Constitucional, and the Asamblea Legislativa in order to demonstrate everything the Municipality had done to improve service quality and comply with the sanitary orders. The report also sets out a comprehensive plan of actions, investments, and procurements to be undertaken to comply with AyA’s reports and the Ministry of Health’s sanitary orders. (...). Following the meeting of 04 de junio del 2019, the Institute (...) took the information provided by the Municipality and, on 4 de julio del 2019, through official letter PRE-2019-00825, set out a series of steps that the municipal aqueduct would be required to take to comply with sanitary order 236-2018.
The Institute thus verified that the local government has not remained passive regarding the improvements that must be made to the aqueduct’s infrastructure. (...). Among the various actions being undertaken by the municipal corporation is budget amendment 14-2019, adopted through resolution number 3429-2019 at Municipal Council ordinary session 170-2019 of 05 de agosto del 2019, which allocates funding to carry out the projects entitled ‘maintenance and supplementary works (public works) at the tanks and springs of the Canton of Santa Bárbara’ and ‘implementation of water storage tanks for human consumption.’ It also strengthens the engineering-services account for procuring operational oversight, likewise by AyA.” Thus, the Municipality has demonstrated its interest and diligence in making the relevant improvements to the drinking-water service. However, this is a comprehensive rather than compartmentalized process, and the infrastructure backlog is longstanding, an issue that any other operator assuming responsibility in the area will have to address (...).
Following approval of the aforementioned budget amendment, the Municipality issued the initial decisions for projects ‘x’ and ‘x,’ which form part of the overall aqueduct improvement plan intended to comply with the requirements of the Ministry of Health and the Institute (...). Beginning in the month of ‘x,’ the Contraloría General de la República endorsed the contract for the Procurement of Water Meters for micro-metering of the drinking-water service in the Canton of Santa Bárbara. Two objectives are intended to be achieved through that contract: the first is to increase revenue in order to invest in and expand municipal aqueduct services, and the second is to raise awareness regarding water consumption and achieve better rationing of that resource.” Counsel for this defendant asserts that, through its complaint, the plaintiff seeks to appropriate powers that do not belong to it under the law, which precludes it from bringing the action in the manner it has.
Granting the relief sought in the judgment—as we understand it—would violate the principle of legality (principio de legalidad), for the same reason concerning statutory powers. The same objection raised against the technical reports commissioned by the plaintiff was also raised against those prepared by AyA at the plaintiff’s request. Finally, the following was stated: “With respect to the municipal aqueduct, past administrations have neglected the aqueduct systems. Nevertheless, it should be emphasized that Santa Bárbara has a single rate because it lacks micro-metering. Thus, under the approved and published rate (...), the monthly charge for residential service is ¢4.700. That rate has been insufficient. The report prepared by the Municipality contains a budget projection under which 10.080 water services are projected for the year 2020; based on the current rates, the aqueduct’s annual budget would be approximately ¢658.864.800,00, an amount insufficient to cover the maintenance, investment, and expansion of the municipal aqueduct.
For this reason, the Municipality obtained a loan from IFAM in order to increase revenue through consumption-based charges and improve water-use efficiency. Accordingly, on 21 de junio del 2019, through official letter DCA-2236, the Contraloría General de la República endorsed contract 05-2019 for the purchase and installation of metering assemblies for the Santa Bárbara aqueduct, public tender 2017-000001-CL.
In addition to the foregoing, an AyA report established a comprehensive work plan, along with the investments and administrative procurement procedures to be undertaken, in order to comply with the sanitary orders issued by the Ministerio de Salud and the AyA reports. To that end, budget amendments have been made to provide funding; these include agreement 3429-2019, adopted at ordinary session 170-2019 of the Consejo Municipal de Santa Bárbara, through which resources are being allocated to the municipal water-supply system so that the scheduled procurement procedures may begin in order to ensure the quality of water for human consumption. Likewise, budget amendments have been made to address the needs of the water-supply system, including amendment 11-2019 for engineering services, approved through agreement 3215-2019 at session 161-2019; amendment 10-2019 for the distribution of water by tanker trucks, through agreement 3200-2019 at ordinary session 160-2019; amendment 09-2019 for the distribution of water by tanker trucks, agreement 3169-2019 from ordinary session 159-2019 (these last two amendments are intended to address the impact of the ENOS phenomenon, which causes decreases in the levels of the springs (nacientes)); and amendment 08-2019 for (sic) substitute staffing and coverage for personnel on medical leave, through agreement 3169-2019 from ordinary session 158-2019, all of the Consejo Municipal de Santa Bárbara.
Accordingly, the Administration has always had to provide budgetary support to the water-supply system because the revenue collected through the rate is insufficient; hence the need to begin individual metering (micromedición) and obtain the funds necessary to expand the service. Against this backdrop, it is true that the municipal water-supply system suffered as a result of neglect by prior administrations; however, since 2016, a series of actions have been undertaken (as reflected in the municipal report to AyA and the Ministerio de Salud) following the initial measures taken by the Ministerio de Salud regarding water potability. Since January 2017, the Municipalidad entered into an agreement with the Universidad Nacional for semiannual monitoring of water quality, in order to begin the procurement and installation of chlorination equipment. Improvements, cleaning, waterproofing, and other work have also been carried out on the storage tanks at the spring catchment facilities (captaciones de las nacientes) within the different water-supply systems.
It is implementing projects to increase the collection of financial resources and improve the efficient use of water resources, thereby carrying out a comprehensive plan that encompasses all systems in the Cantón, rather than the fragmented view presented by the plaintiff, who even relies on evidence collected through unsuitable means to portray a situation that does not correspond to the current condition of the municipal water-supply system. Given that the water-supply system is in the process of implementing all corresponding improvements, this municipal entity will continue submitting the documentation generated as a result of that process so that the Tribunal may be fully informed of the Municipio’s progress regarding investment in the water-supply system.” The affirmative defenses (excepciones) of lack of standing (falta de legitimación activa) were raised on the basis of the statutory powers vested exclusively in the co-defendant Instituto and the procedure applicable where that entity decides whether or not to assume administration of a water-supply system pursuant to the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados, sections 12 through 18 contained in chapter III, concerning the requirements and procedures therefor, in relation to article 19 of the same regulatory instrument.
This was linked to the Ley Sobre el Desarrollo de la Comunidad (DINADECO), Ley N° 3859, articles 17, subsection b), and 24, concerning the functions of these associations, in support of the assertion that the plaintiff has no authority whatsoever relating to the oversight and/or supervision of this service. Lack of a legal right (falta de derecho) was also raised as an affirmative defense.-
IV.Regarding the defense arguments raised by the representation of AyA. For its part, the representation of this respondent also opposed the action, arguing that the plaintiff seeks to disregard all the work performed by the Institute in all the systems administered by the co-defendant Municipality, including the water supply system (acueducto) at issue. That the plaintiff relies on evidence consisting of reports dating back 19 years. That it has no knowledge of deficient administration or maintenance of this water supply system by the Municipality. That the plaintiff refers to samples corresponding to bacteriological and sanitary verification controls conducted in 2001 and which are therefore outdated. That the fact that the Institute may have addressed one or more requests does not entail a duty to assume administration of the water supply system; rather, in the exercise of its authority, it issued technical recommendations concerning actions that the operator of this asset was required to undertake, and the water supply system was intervened in at the appropriate time pursuant to a judgment, with recommendations issued to improve the service and the condition of the water supply system.
That: “No reliable and current technical evidence has been submitted regarding the facts described to demonstrate that the assertions made have any basis in reality; and standing (legitimación) cannot be based on mere speculation or an arbitrary assertion, because our legal system is founded on good faith, legality, and the reasonableness of conduct, not on arbitrariness. AyA has been carrying out a series of interventions in the Santa Bárbara de Heredia water supply system pursuant to health order N° 236-2018 issued by the Ministerio de Salud. This intervention has generated a series of information and documentation concerning the administration of that water supply system, making it possible to ascertain and diagnose its current condition. By virtue of the available information and based on the results of the water-quality analysis detailed in official letter PRE-LNA-01168 (...) corresponding to monitoring conducted between 18 y el 20 de junio del 2019 in the distribution network of each of the 21 systems comprising the Santa Bárbara water supply system, the following was determined: ...
Of the 21 systems monitored, indicators of fecal contamination were detected in two samples from two of them: Setillal Norte de Puraba de Santa Bárbara (sistema Quirós) and Jesús de Santa Bárbara (Cuesta Colorada), representing 3% (2/62) of the points sampled in the water supply systems administered by the Municipalidad de Santa Bárbara that provide non-potable water. These water supply systems serve approximately 3428 people (according to data from 2014), representing 13% of the population served by the systems administered by the Municipality.” “In addition, 62 free residual chlorine measurements were taken (since all systems are reported as chlorinated), of which 47 were below the minimum value specified by the Regulations, representing 76% (47/62) of the water supply systems administered by the Municipalidad de Santa Bárbara. Furthermore, two measurements exceeded the permissible upper value for free residual chlorine, representing 3% (2/62) of the measurements (sistema Ruiseñor in Urbanización Ruiseñor de Jesús de Santa Bárbara and sistema Mesén in Urbanización mesén de Birrí).
The entity I represent submits a detailed report corresponding to a study of the ‘current condition of the Acueducto Amapola,’ using random sampling points and areas known to have problems. Consequently, and in accordance with the findings of technical report UEN-PyD-GAM-2019-00372, the priority for the Amapola system is to implement operational water-quality control in the distribution networks, so that the established recommendations concerning proper chlorine dosage and constant monitoring of the networks are followed. Under these instructions, the operator will be able to ensure compliance with residual chlorine levels in the networks, in accordance with the acceptable ranges established in the Water Quality Regulations. Finally, regarding the complaint submitted by the Asociación de Desarrollo Integral del Roble de Santa Bárbara de Heredia, the following is indicated: The diagnostic report submitted contains information collected in 2013.
For this reason, some of the conditions described in that report do not correspond to the information collected by AyA during 2018. It is alleged that there is a stream and that the Municipality draws surface water from that stream for incorporation into the system’s production. The AyA report warns of the proximity of certain springs (nacientes) in this system to a stream that, during the rainy season, may overflow its banks and inundate the area where the spring is located; these situations must therefore (sic) be monitored and appropriate measures taken to protect the spring and prevent surface water from seeping into the protective enclosure. However, at no point does it state that surface water drawn from the stream is being injected into the system, since this was not observed during the visits. It is alleged that the AyA report states that fecal coliforms were found in the Amapola system.
It must be clarified here that the coliforms appeared in samples taken at the springs; however, the report states that, although residual chlorine levels in the distribution networks do not strictly comply with the ranges established in the Regulations, the laboratory results also show that no coliforms were found in the network, meaning that the water consumed by users is free of coliforms due to the disinfection process being performed. Indeed, with respect to the Amapola system’s disinfection system, the First Progress Report recommends strict operational control to ensure adequate residual chlorine levels in the network, since the disinfection equipment is appropriate and functions properly. The most recent follow-up report on the Action Plan shows that the Municipality replaced the disinfection system to improve control over chlorine dosage. In addition, a globe control valve was installed before the flowmeter.
The person responsible for performing disinfection in the water supply system was asked about dosage control, and he stated that he keeps a logbook in which he records all field data. He further stated that on Mondays and Tuesdays he travels throughout the water supply system to place chlorine tablets in all the equipment, and that on the remaining days he takes residual chlorine measurements throughout the system. If a situation arises in which residual chlorine is outside the permitted parameters, the measurements must be postponed in order to resolve the situation. The foregoing is in compliance with the schedule established in the 2do Progress Report for the improvement measures that the Municipality must implement over the next 5 years. The twenty-fourth point refers to an alleged verbatim quotation taken from the First Progress Report, as shown below: ‘As for the spring collection tanks and the Amapola storage tank, they lack water chlorination, maintenance, cleaning, and access to the tanks; they have no warning signs and no perimeter security.’ Stating that the system lacks water chlorination does not correspond to any passage in the cited report and is inconsistent with the accuracy of the information collected by AyA both in 2018 and during the 2019 follow-up inspections, since the Amapola system does have disinfection systems, as demonstrated by the laboratory results recording the chlorine concentration at the points sampled in the network.
It is clarified that AyA, as the entity specializing in the field, or the Municipalidad de Santa Bárbara, with respect to the area in which the local water supply system operates, are the entities that, on the basis of technical studies and assessments, define and decide which water-treatment option is appropriate; this is not a decision for a private individual, since such an individual lacks the knowledge, expertise, and information, and AyA has been carrying out an intervention in the water supply systems of the Municipalidad de Santa Bárbara de Heredia, through which the backlog that existed in this field in the area was reduced. The institutions have achieved major improvements to the local water supply system, considering that it is a complex system comprising 21 systems. AyA has worked on the front line to improve the Municipal water supply system in order to provide quality, efficient, and continuous water service to all communities in Santa Bárbara de Heredia.
It is important to emphasize that, in many cases, the population does not use the resource rationally and that both operators and users bear responsibility in this area. In this regard, the institution has a series of programs, including the programa bandera azul, defensores del agua, training in schools, preservation, and awareness-raising regarding the need to use water resources rationally, responsibly, and in solidarity. These initiatives provide education and outreach nationwide, not only for AyA users, and thereby seek to promote social engagement and greater awareness of the need for every citizen to recognize their personal responsibility regarding an issue that affects us all and whose solution, in many cases, lies in the hands of users, who waste the resource to a considerable extent while demanding sufficient quantities of high-quality water to wash vehicles, water lawns, etc. At present, the population must understand that natural events have caused a sharp decline in groundwater and surface-water sources, affecting the entire country and not merely part of the population.
This has been exacerbated by the excessive and poorly planned growth of urban developments. In many cases, strong economic interests place considerable pressure on authorities to approve construction, particularly social-interest projects, which generate the greatest pressure on water demand. Accordingly, such situations could potentially be addressed, planned, and scheduled only through the Local Government, by means of an essential instrument in these cases: land-use planning (ordenamiento territorial). It should be recalled that the Ley de Planificación Nacional provides that developments may not be authorized unless basic services are available or if such developments are premature. This is therefore a fundamental mechanism available to Local Governments, unlike other institutions, such as AyA, which must respect municipal autonomy. Notwithstanding the foregoing, it is reiterated that the facts alleged by the petitioner should not, in principle, be known to the entity I represent, because the Institute neither operates nor administers the water supply and sewerage system (sistema de acueducto y alcantarillado) in the Santa Bárbara de Heredia area.
It is a system administered by the Local Government. Nevertheless, these water supply systems have experienced serious problems from an overall perspective, of which AyA is aware through various measures undertaken by the Local Government for the purpose of providing and improving the water supply service under its administration.
All necessary improvements and recommendations concerning the water-supply system (sistema de acueducto) administered by the Municipalidad de Santa Bárbara, issued by AyA, are set forth in official letter UEN-PyD-GAM2019-00372, dated 18 de julio de año 2019, signed by Ing. jorge Luis Espinoza Bolaños of the UEN Producción y Distrubución GAM, and its annexes. Therefore, what the Municipalidad must actually do is devote itself to implementing the improvements identified through various studies and meetings. As has already been stated on several occasions, the studies conducted by AyA make a series of recommendations that are the responsibility of the operator (operador) to implement, which will enable it, to some extent, to optimize the water-supply system. This must be addressed by the system administrator, which in this case is the Municipalidad; for its part, it must establish a rate that enables it to cover not only operating and administrative costs but also a return on investment, as required by the Ley General de Agua Potable.
It is emphasized and reiterated that AyA does not have coercive mechanisms to compel the Gobierno Local to carry out the improvements; therefore, the matter is entirely the responsibility of the Municipalidad, regardless of the monitoring that AyA may provide in this regard. It should be noted that, given the authority vested in the Municipalidad to administer the water-supply system, and because we, as public institutions, are governed by the principle of legality (Principio de Legalidad), and therefore also by budgetary legality (legalidad presupuestaria), we must comply with express statutory provisions that preclude interventions in systems not administered by AyA, as provided in the Ley Constitutiva de AyA, Ley Financiera de la República de Presupuestos Públicos, and particularly as mandated by article 10 of the Ley General de Agua Potable, which clearly establishes the responsibility of the water-supply system operator in this respect, whether AyA or a municipality.
At no time has this Instituto agreed with the Asociación de Desarrollo Integral del Roble de Santa Bárbara de Heredia; on the contrary, AyA is conducting the relevant assessments to determine whether or not it will assume responsibility for the water-supply system. Based on the recommendations issued to the operating entity (ente operador), it will be possible to assess whether responsibility for the entire water-supply system should be assumed; however, it can be stated quite specifically that the La Amapola system does not currently pose a public-health risk, based on the assessments performed and the tests conducted by the Laboratorio Nacional de Aguas. AyA is awaiting the results of the recommendations issued to the operator; therefore, it is far too early to assert that the administration of such a complex water-supply system, on which work has been ongoing, should be taken over. Likewise, if the Instituto were to decide to assume responsibility for it, it would be within its discretion, based on the technical reports, to determine whether the best option would be to delegate it to an Asada, which would require an agreement by the Junta Directiva." The only affirmative defense (excepción de fondo) raised was lack of legal entitlement (falta de derecho).-
V.Proven facts. The following facts relevant to the resolution of these proceedings are deemed proven:
(The images numbered 117 through 120, in relation to those numbered 121 through 125 of the judicial case file);
The record shows that this Health Governing Area Directorate has carried out all manner of interventions to improve the quality of the water supplied to the residents of Santa Bárbara, including (...); however, the expected results are not those that the population deserves, to the point that after one (sic) two years, the canton's water has still not been made potable, thereby placing public health at risk. Therefore, and in accordance with the foregoing, an analysis of the Technical Rule (Regla Técnica) is being conducted to determine what other extraordinary measures may be taken in this regard." (Images 640 through 643 of the judicial case file); 23) That, pursuant to official letter N° MS-DRRSCN-DARSSB-912-2019 dated 21 de agosto del 2019 from the Santa Bárbara Health Governing Area Directorate, Central-North Regional Health Governance Directorate of the Ministerio de Salud, identified as N° 21 de agosto del 2019 and addressed to the entity identified as the "Comité de Vecinos de Calle Amapola," it was stated, in relevant part, that: "According to the latest water-quality operational report submitted by the Municipalidad de Santa Bárbara on 3 de junio del 2019, the supply system that relies on the Amapola spring (Naciente Amapola) complies with the Water Quality Regulation (Reglamento para la Calidad del Agua) in the Level One (N1) analysis, which includes pH, conductivity, turbidity, apparent color, temperature, odor, and the presence of residual chlorine between 0.3 and 0.6 mg/L.
No fecal coliforms or E. coli were reported at the spring, storage tank, or distribution network, as may be seen in report N° AG-134-2019 prepared by the Laboratorio de Análisis Ambiental de la Universidad Nacional on 12 de marzo del 2019. It is also reported that, between 18 y 20 de junio de 2019, the Instituto de Acueductos y Alcantarillados conducted water-quality sampling in the distribution network of the Amapola system. The sampling showed noncompliance with water-disinfection requirements because the residual chlorine levels were below the recommended limits; no fecal coliforms or E. coli were reported in the distribution network. With respect to the inquiry concerning report CN-ARS-SB-1241-2017, said report concerns the water-quality analyses for the first half of 2017; it states that residual chlorine levels were below those recommended and that fecal coliforms were present at the spring, storage tank, and distribution network.
Therefore, the water was deemed non-potable because it did not comply with the Drinking Water Quality Regulation (Reglamento para la Calidad del Agua Potable). A summary table for the most recent five-year period concerning the presence of residual chlorine and fecal coliforms in the Sistema Amapola is attached:

VI.Unproven facts. The following are deemed unproven facts relevant to the resolution of these proceedings: 1) That, as a result of the operation of the system administered by the Municipalidad named as a defendant, known as “La Amapola” and constituting a component of the municipal water-supply system at issue, the public potable-water supply service (servicio público de suministro de agua potable) provided may, from a technical and/or scientific standpoint, be deemed inefficient; or, as applicable, that it has been determined, also from a technical and/or scientific, public-health, and financial standpoint and within the framework of the most appropriate provision of potable-water supply service, that it would be advisable for this system alone to be administered by AyA, or that there are budgetary considerations that would not constrain a decision to that effect. (The absence of evidence in this regard); 2) What technically and/or scientifically verifiable parameters must be present or are necessary to determine that a potable-water supply service is inefficient. (The absence of evidence in this regard).-
VII.On the merits. It is the opinion of this Chamber that, in the present case, the claim must be dismissed in its entirety, based on the following considerations:
Taking into account that the system in respect of which Mr. Fernando Sánchez Redondo conducted his expert examination—as well as a subsequent one that will be addressed below—is not municipally owned but, rather, is owned by the plaintiff herein, he would not have engaged in a prohibited activity even if he had manipulated a component of the aqueduct (acueducto) for purposes of observation, but instead in an activity that, under these Regulations, the Municipality would have deemed punishable from a criminal-law standpoint, without the municipal representatives having explained in their arguments what criminal offense was allegedly committed. The same provision then establishes disconnection of the service as an additional consequence, which the representatives of the defendant Municipality do not even claim occurred. The provision of these Regulations that does establish prohibitions for the subscriber (abonado) is the following, namely Article 46, which, insofar as relevant, prohibits “...any installation, construction, or work within areas near supply sources, purification plants, or any other part of the system that in any way impairs operational or distribution activities, or the physical, chemical, or bacteriological conditions of the system, and that causes or may cause harm to the system or to public health.
The protection zones established in the Cantonal Regulatory Plan, where applicable, or in the legislation governing the matter, must be respected.” (Emphasis and underlining not in the original.) Nor was it asserted in the response to the complaint that effects such as those described were attributable either to Mr. Fernando Sánchez Redondo, to the company for which he works, or to the plaintiff Association as subscribers; moreover, one of the matters specifically noted in this expert report is the absence of structural protective features for the spring (naciente) located on private property. Now, on 01 September 2014, insofar as relevant, officials of the Dirección Área Rectora de Salud Santa Bárbara, Dirección Regional de Rectoría de la Salud Central Norte del Ministerio de Salud filed a criminal complaint for the offense of disobedience of authority with the Fiscalía de San Joaquín de Flores de Heredia against the persons then serving as Mayor and President of the Consejo Municipal, respectively, both of the Municipalidad de Santa Bárbara de Heredia, based on their failure to comply with a sanitary order (orden sanitaria) identified as N° 10-2014, pursuant to which they had allegedly been granted a period of three months to carry out physical and sanitary improvements at the spring, such as installing perimeter fencing around the collection and storage tanks, replacing rusted covers, painting the tanks, removing waste from the watercourse, and replacing the conveyance piping made of asbestos material.
The order arose from an inspection conducted on 14 May 2014 at Naciente La Amapola, located on Calla La Amapola, Santo Domingo del Roble, Santa Bárbara. During a subsequent site visit on 21 August of that same year, 2014, noncompliance with the sanitary order was observed; consequently, it was asserted that public health was clearly at risk due to water contamination resulting from the spring’s physical and sanitary conditions. (Images 126 through 128 of the judicial case file.) Up to this point, the assertion made by Mr. Fernando Sánchez Redondo regarding the system’s collapse remained valid; it has not been denied by the municipal representatives and, on the contrary, upon review of the response to the complaint, it would appear that they acknowledged that this was the situation as of that date, primarily for municipal budgetary reasons. We then come to 2017, when, under Sanitary Order No. 242-2017 issued by the Dirección del Área Rectora de Salud de Santa Bárbara de Heredia del Ministerio de Salud and served on the defendant Municipality herein on 20 March 2017, the Municipality was ordered to take the following actions concerning the municipal aqueduct: 1.
Obtain the sanitary operating permit within one month. 2. Submit, within fifteen business days, a compliance schedule allowing no more than six months for implementation and including the following points: a. Implement, in 100 % of the systems managed by the Municipalidad de Santa Bárbara, a daily and effective disinfection protocol that meets acceptable residual chlorine levels, prioritizing the (...) Amapola (...) systems. b. Submit monthly logs of the disinfection performed in each of the systems managed by the Municipality. c. Internally and externally wash the collection and storage tanks of the systems managed by the Municipality, in the order of priority indicated. d. Submit the Municipal Aqueduct Water Quality Control Program, including: the area served by the water-supply system (aqueduct sketch, description of the area, and identification of risks and vulnerabilities) and sampling (collection frequency and collection points). e. Clean the perimeter channels and the areas surrounding the springs and the collection and storage tanks of the systems managed by the Municipality. f. Install perimeter fencing around the collection facilities and storage tanks of the systems managed by the Municipality and provide each with its corresponding padlock. g. Replace all covers of the collection and storage tanks of the systems managed by the Municipality that are in poor condition and provide each with its corresponding padlock. h. Repair leaks and cracks in the collection and storage tanks of the systems managed by the Municipality that are in poor condition. i. Paint the collection and storage tanks of the systems managed by the Municipality whose paint is in poor condition. j. Periodically submit water-quality reports. 3.
Submit, within three months, a diagnostic assessment of the conveyance network of all systems managed by the Municipality that is located within the storm-sewer system and exposed to contamination by wastewater. This was based on the results of reports on water quality dated 17 February 2017 prepared by the Universidad Nacional and on what were characterized as troubling deficiencies involving little or no residual chlorine in 24 of the sampled systems of the aqueduct at issue, equivalent to 80% thereof, which therefore failed to meet acceptable disinfection levels. In addition, fecal coliforms and/or E. coli were present in storage tanks and the distribution network in 50% of those systems and in springs in 26%, with results showing that 76% of the aqueduct was contaminated. (Images 117 through 120, in relation to images 121 through 125 of the judicial case file.) At this point, as can be seen, the condition of the aqueduct was critical in terms of service delivery.
Thus, according to the microbiological and chemical analysis of the aqueduct at issue for the first half of 2017, which examined approximately 23 springs corresponding to 17 aqueduct systems in the canton of Santa Bárbara de Heredia, including the system known as “La Amapola,” the latter was determined to fall within the very-high-risk classification because fecal coliforms and E. coli had been detected and because chlorine did not reach adequate disinfection levels. Among the various systems, this one displayed the highest level of contamination of this kind, both in the storage tank and at the three levels of the distribution network. It was concluded, in general terms, that 64.3% of the systems comprising the aqueduct did not meet acceptable disinfection levels and that 58% displayed contamination at some point in the network. On that basis, it was ordered that a sanitary order be served requiring the residual chlorine levels to be adjusted to the values recommended by law and the necessary measures to be taken to eliminate the levels of contamination present in the municipal aqueduct.
(Images 86 through 96 of the judicial case file.) In fact, under the decision of the Sala Constitucional de la Corte Suprema de Justicia identified as N° 2017-9566, issued at 09:45 hrs. on 23 June 2017, the defendant Municipality herein was ordered, insofar as relevant, to do the following: “(...) comply with the provisions issued by the Área Rectora de Salud of that canton in Sanitary Orders No. 242-2017 of 20 March 2017 and No. 497-2017 of 12 May 2017.” This was based on the fact that, following the filing of an amparo proceeding (recurso de amparo) by local residents who had expressed dissatisfaction with the drinking-water service, this High Court of constitutional review determined that: “...the deficiencies described reveal a problem that poses a risk to the residents of the municipality and that, therefore, this Court cannot disregard. (...). Consequently, based on the information provided by the Dirección del Área Rectora de Salud de Santa Bárbara at this Court’s request, it is clear that the situation challenged in the amparo violates the petitioners’ rights to water and to the proper functioning of public services and constitutes a serious failure by the Municipal Administration to fulfill its unavoidable obligation, as administrator of local interests and services, to satisfy the demands of those subject to its administration within its respective sphere of authority.” (Emphasis not in the original.
Images 97 through 107 of the judicial case file, together with a search conducted on the “web” page of the Sistema Costarricense de Información Jurídica.) Now, under official letter N° CN-ARS-SB-986-2017 dated 29 September 2017, issued by the Ministerio de Salud, Dirección de Rectoría de la Salud Central Norte, Dirección Área Rectora de Salud Santa Bárbara, signed by its Director, Ms. María Antonieta Acuña Hernández, and addressed to the defendant Municipality herein as a follow-up to the sanitary order identified as N° 242-2017 and the aforementioned decision of the Sala Constitucional, it was determined, insofar as relevant and as a result of inspection visits conducted on 27 and 28 September 2017, that the following conditions existed at the La Amapola tank and Naciente La Amapola serving the El Roble drinking-water supply sector: “It has a chlorination system; chlorine tablets were observed inside the cylinder; it has no leaks; however, the tank has substantial overflow; the interior of the tank appears clean; the upper portion requires painting; it has perimeter fencing; and the covers are rusted and in poor condition.” (Emphasis not in the original.) Total or partial noncompliance, as applicable, with sanitary order N° 242-2017 was also established, insofar as relevant, because monthly logs of the disinfection performed had not been received; a water-quality control program had not been submitted; leaves, sticks, and weeds were observed in some of the perimeter channels and around the storage and collection tanks; the drinking-water quality analyses corresponding to the first half of 2017 had not been submitted; and neither the diagnostic assessment of the conveyance network located within the storm-sewer system nor the activity schedule specifying the measures for relocating that conveyance network had been submitted. (Images 51 through 61 of the judicial case file.)
Thus, although the problems identified by the Ministerio de Salud continued to exist as described above, some improvements were already being made by September 2017. By the end of that year, specifically on 01 de diciembre del 2017, the respondent Municipalidad was notified of health order N° 1242-2017 issued by the Ministerio de Salud, Dirección de Rectoría de la Salud Central norte, Dirección Área Rectora de Salud Santa Bárbara, signed by its Director, Ms. María Antonieta Acuña Hernández, stating, insofar as relevant, that, after water-quality reports had been received from health authorities and the environmental analysis laboratory of the Universidad Nacional, it had been established that: “... fecal coliforms and/or E coli are present in the springs (nacientes), storage tanks (tanques de almacenamiento), and/or distribution network of 10 of the 17 systems analyzed, with the La Amapola system having the highest level of contamination in the storage tank and distribution network.
(...). Based on the foregoing, the following is ordered: 1- Adjust the residual chlorine levels in the La Amapola systems (...) to a range of 0.3 to 0.6. Deadline: 5 business days. Legal basis (...) Decreto N° 38924-S. / 2- Implement the measures necessary to eliminate fecal coliforms and E coli from the contaminated systems, giving priority to the Amapola systems (...). Deadline: 10 business days. (...) Decreto 38924-S.” / 3- Conduct new fecal-coliform analyses in the distribution network of the Amapola systems (...). Deadline: 15 business days. (...). Decreto 38924-S.” (Emphasis not in the original. Images 83 and 84 of the judicial case file). It therefore appears that, by the end of 2017, one of the most significant water-quality problems was contamination by fecal coliforms and/or E coli. Another matter related to the issue before us was again heard by the Sala Constitucional de la Corte Suprema de Justicia, which, in its Voto N° 2017-20135 of 09:20 hrs. on 15 de diciembre del 2017, ordered AyA, insofar as relevant, as follows: “(...) to issue the corresponding orders within the scope of its authority so that, WITHIN ONE MONTH from service of this judgment, the relevant studies are conducted to guarantee the quality of the water from the water-supply system (acueducto) reported in the complaint and to decide the request submitted by the petitioner Asociación for intervention in the water-supply system.” (Images 108 through 111 of the judicial case file, together with a search conducted on the “web” page of the Sistema Costarricense de Información Jurídica).
We now reach 2018, when—although its precise date cannot be established, we assume as a consequence of what was ordered by the Sala Constitucional—AyA prepared an intervention report arising from a health order identified as N° 236-2018. Regarding the water-supply system at issue, identified as “La Amapola,” the report stated that it is supplied by 6 springs, from which their flow is conveyed to the “Tanque Amapola”; that a sanitary inspection (inspección sanitaria) was conducted; and that, at the site identified as “Naciente Amapola A,” improvements had to be made to the access to the spring, including the construction of concrete steps; the inspection covers had to be replaced because the existing ones were in poor condition; the runoff-water drainage system and the slab of the protective chamber had to be cleaned, after which the slope of that slab had to be assessed; signs had to be posted stating, among other things, that it is a spring supplying water for human consumption; grates had to be installed on the overflow and cleaning pipes; and, finally, a spring-maintenance program including painting had to be prepared and implemented within no more than six months.
At the site identified as “Naciente Amapola La Virgen,” the access to the spring had to be improved, including the construction of concrete steps; perimeter fencing had to be installed to protect the protective chamber from access by persons or animals to the spring; the inspection cover had to be replaced because it was in poor condition; the runoff-water drainage system had to be cleaned; signs and grates on the overflow and cleaning pipes had to be installed; and a spring-maintenance program, including painting, had to be prepared for implementation within six months. At “Naciente la Amapola B,” the access to the spring had to be improved; perimeter fencing had to be installed; leaks in the spring’s protective chamber had to be repaired; inspection covers had to be replaced; the spring’s protective chamber had to be cleaned and painted; a runoff-water drainage system had to be constructed for the spring; signs and grates on the overflow and cleaning pipes had to be installed; and a spring-maintenance program including painting had to be prepared for implementation within six months.
For “Naciente Amapola C” and “Naciente Amapola D,” practically the same measures as those described above were required. At the facility called “Tanque de reunión de nacientes Amapola,” access had to be improved; perimeter fencing had to be installed; the inlet pipe had to be properly connected to the tank; inspection covers had to be replaced; the tank had to be cleaned and painted; a runoff-water drainage system had to be constructed; signs and grates on the overflow and cleaning pipes had to be installed; tank vents had to be installed; and a spring-maintenance program including painting had to be implemented within six months. At “Tanque de almacenamiento Amapola,” the tank slab had to be waterproofed; a sidewalk had to be constructed around the tank; internal walkways and grates on the overflow and cleaning pipes had to be installed; signs had to be posted; barbed wire had to be installed on the perimeter fencing; and a maintenance program had to be implemented within six months.
Regarding the disinfection system, it stated that a microbiological analysis had determined that water analyzed from the spring collection tank contained fecal coliforms, although they were not present in the storage tank or the network, and that the residual-chlorine values obtained were within the acceptable range under the Reglamento para la Calidad de Agua Potable. It therefore recommended repairing the Amapola B spring chamber; improving the covers and sanitary seals of the springs and collection tank; fencing and performing general maintenance on the collection tank; and covering the conveyance line along the sections where it was exposed. The disinfection equipment installed at the Amapola tank was operating properly; nevertheless, the dosage had to be regulated and monitored to ensure compliance with acceptable residual-chlorine values in the distribution network. Finally, an improvement program covering the Amapola distribution network was included, and it concluded, insofar as relevant, as follows: “... fecal coliforms were found in springs belonging to the (...) amapola (...) systems.
Implementation of the measures recommended in this report will help reduce the sanitary vulnerability of the water-supply systems ...”. (Images 150 through 195, in relation to images 234 through 550, all from the judicial case file). It bears emphasizing that, by this date, the water was already being disinfected and that, although fecal-coliform or E coli contamination was detected in the upper section of the system, it was not detected in the lower sections. We reach the middle of 2018, when, according to a document entitled “progress report” issued in June in connection with AyA’s intervention in the Santa Bárbara de Heredia water-supply system, it was recommended that the Municipalidad plan for and purchase the land on which the springs and storage tanks were located, and that the Municipalidad should “consider” obtaining access easements (servidumbres de acceso). Recommendations were issued concerning perimeter fencing for water intakes (captaciones) and storage tanks; inspection covers; protective railings; internal and external ladders; vents; waterproofing and exterior painting of storage tanks and spring protective chambers; slab waterproofing; washing sidewalks; protective cages; construction of walkways; and construction of concrete steps.
(Images 62 through 82 of the judicial case file). Before this, on 07 de marzo del 2018, AyA, through its Presidencia Ejecutiva, wrote to the plaintiff Asociación, stating in summary: “In accordance with the order of the Sala Constitucional and within the scope of our authority, you were informed that AyA did, in fact, inspect the sources and facilities supplying the Santo Domingo del Roble de Santa Bárbara de Heredia water-supply system, and that the results of that inspection, during which you accompanied AyA, were provided to the Gobierno local so that it could arrange the corrective measures necessary to ensure optimal provision of the service; those recommendations were not limited to the issue of water quality. The recommendations issued in that report are comprehensive and are intended to bring about substantial and fundamental improvements in service provision. / Regarding water quality, as you are well aware, the inspection was conducted without notice to the Municipalidad, as a result of which the Alcalde expressed his disagreement to the Institución.
Nevertheless, it is clear that the Gobierno Local took no action to alter the quality of the water it supplies because it was unaware that the inspection would be conducted. Accordingly, the specific result obtained shows that, at that particular time, the water supplied by the Municipalidad in that area was drinking water (agua potable), and therefore the justification for a potential intervention lacks factual and technical support in light of the data obtained by the Laboratorio Nacional de Aguas (LNA). Nevertheless, the need to make improvements and to assess a potential intervention in greater detail was recommended, since only one specific data point from the LNA is available. For that reason, and in full observance of and respect for the authority of each entity, particularly municipal autonomy and the provisions of Article 10 of the Ley General de Agua Potable—which prevents us from using the rates paid by our users to incur costs relating to systems not administered by the Instituto—the Municipalidad is requested to conduct the relevant studies and works to improve the conditions of that water-supply system and to provide us with the information that AyA will use as the basis for assessing potential impacts on public health and the possible intervention in the system.
As you can see, various actions have been taken, copies of which are provided to you, all in accordance with the order of the Sala Constitucional and in adherence to the principle of legality and the authority of each entity.” (Emphasis not in the original. Images 196 and 197 of the judicial case file).
This Court must pause here to indicate that, on the basis of the determination made by the national governing authority regarding the provision of the drinking-water supply service, and notwithstanding this Court’s difficulty in understanding the scope of the “intervention” activities, at least at this point or state of affairs in March 2018, the contamination issue was deemed to have been adequately mitigated, to such a degree that it was concluded that the water supplied was potable. Based on this conclusion, which was no longer merely technical but scientific, it was then asserted that the factual and “technical” support justifying the intervention had ceased to exist in light of the data obtained by the Laboratorio Nacional de Aguas (LNA). The seriousness of this assertion is not insignificant for purposes of the claim being adjudicated under the terms of this judgment, since, given that the water supplied through the provision of the service was considered potable and, consequently, the justification for an intervention was considered questionable by offices within AyA itself, the plaintiff was required to challenge that assertion with technical or scientific evidence supporting a different conclusion, which it did not do, irrespective of the financial cost this would have entailed for it.
In fact, there is expert evidence (prueba pericial) of that nature, from that same period, obtained by the plaintiff herein, consisting of a second expert report prepared by the company known as “Ingenieros Consultores y Ejecutores de Acueductos S.A.” on 07 de marzo del 2019, this time addressed to the plaintiff Asociación. According to that report, following an inspection conducted at the site in question on 26 de febrero del 2019, it was determined, in summary, that: “... this system generally has a series of structural and sanitary deficiencies and fails to comply with the standards established for drinking-water supply, to the detriment of and posing a risk to the health and quality of life of the community of El Roble de Santo Domingo de Santa Barbara. I must also note that, in julio del 2013, in an initial report, I had already identified this entire series of system deficiencies and, nearly six years later, the same problems in the operation of the water-supply system persist, demonstrating a complete lack of attention and interest on the part of the system administrator, as well as a lack of adequate knowledge regarding the operation of a drinking-water supply system.
A detailed Technical Study must urgently be conducted to establish the logical and orderly planning of improvements in stages.” (Images 38 through 48 of the court case file). It should be noted that the claim before this Court was filed with the courts in abril del 2019. Now, although it is clear that this report contrasts with AyA’s assertions, it does not contain any analysis of water quality that discredits the conclusions reached by that Institute, the governing authority in this field. That issue is therefore outside the scope of the expert report submitted by the plaintiff Asociación, and the report consequently does not support any conclusions regarding whether AyA’s actions lacked technical and/or scientific objectivity. It is established that, through official communication No. MS-DRRSCN-DARSSB-840-2019 of 14 de junio del 2019, the defendant Municipalidad was formally ordered (apercibimiento) by the Dirección Área Rectora de Salud Santa Bárbara, Dirección Regional de Rectoría de la Salud Central Norte del Ministerio de Salud, to take immediate measures, based on the results of a report from the Laboratorio Nacional de Aguas concerning samples collected on 18 y 20 de junio del 2019, according to which: “... it is reported that, of the 21 systems monitored, 62 free residual chlorine determinations were performed, of which 47 did not reach the minimum value specified in the Regulation on Water Quality; furthermore, fecal coliforms (E coli) were detected in the Jesús de Cuesta Colorada and Zatillal Norte systems.” (Image 644 of the court case file).
From the absence of any mention of the “Amapola” system, it must be concluded that the system did not present a contamination problem of that kind at that time. In that same month of junio del 2019, after the defendant Municipalidad had initiated an administrative procurement procedure (procedimiento de contratación administrativa) for the purchase and installation of metering assemblies for the municipal water-supply system, the corresponding contract was endorsed by the Contraloría General de la República by at least 21 de junio del 2019. (Image 747, in relation to images 748 through 770 of the court case file). Thus, two months after the aforementioned claim was filed, an administrative procurement procedure for that purpose had already reached a final outcome. Clearly, that procedure must have been initiated sometime before this judicial action was filed, and measures had already been undertaken concerning infrastructure, with budgetary implications.
Continuing with the matter, the issue concerning the Amapola system and water quality has persisted over time. Thus, under the document identified as a memorandum, dated 03 de julio del 2019, from AyA’s Laboratorio Nacional de Aguas, the Executive Presidency of that Institute was informed, insofar as relevant, that although indicators of fecal contamination had been found in two of the systems comprising the water-supply system, neither of which was identified as the system known as “Amapola,” that finding represented 3% of the sampled points after samples were taken from the 21 systems operated by the Municipalidad in connection with its administration of the water-supply system at issue. This would have included water-quality analyses for all of the systems comprising the water-supply system. (Images 557 through 561 of the court case file). Now, although it is true that AyA officials filed a new criminal complaint against officials of the defendant Municipalidad, the text of that complaint appearing in the record does not reveal any information specifically related to the Amapola system.
Thus, on 10 de julio del 2019, the person identified as the Director of the Área Rectora de Santa Bárbara del Ministerio de Salud filed a complaint with the Fiscalía de San Joaquín de Flores regarding the alleged offense of disobedience of authority against the Alcalde de la Municipalidad de Santa Bárbara, based on events occurring from 2017 onward and, specifically, on the requirements of sanitary order (orden sanitaria) No. 242-2017, which ordered physical, sanitary, and administrative improvements to the municipal water-supply system and was deemed not to have been complied with: “... because it was shown that both in the water-quality analyses for the second half of 2017 (...) the deficiencies in disinfection using residual chlorine continued in most of the water-supply systems; furthermore, the analyses reported the presence of fecal coliforms and E coli in the distribution network (red de distribución).” This was compounded by the fact that, during that period, numerous complaints had been received regarding the presence of sediment (soil) and animals such as earthworms and snakes in the water supplied to homes, suggesting inadequate maintenance of the water-supply system’s components.
As of that date, there was no report on the assessment performed on the conveyance pipeline located in the sanitary sewer system, nor any timetable for relocating the improperly situated pipeline; nor was there any information regarding repairs that may have been made to the storage tanks, replacement of covers in poor condition, installation of perimeter fencing, or painting; and there was no report on the water-supply system’s water-quality control program. (Images 618 through 624 of the court case file). In addition, the text of this document also does not establish the date of any noncompliance related to water contamination after the supplied water had been determined to be potable, as stated above. In fact, since the water was determined to be potable, neither AyA nor the Ministerio de Salud has made any relevant observation regarding its quality. Instead, under internal official communication No. MS-DRRSCN-DARSSB-747-2019, dated 17 de julio del 2019, from the Dirección Área Rectora de Salud Santa Bárbara, Dirección Regional de Rectoría de la Salud Central Norte del Ministerio de Salud, addressed to the Dirección Regional de la Salud Central Norte, a “report on the application of the technical rule to the Municipalidad de Santa Bárbara water-supply system” was forwarded.
It reported that the health impact arising from its operation was high and that continuing to provide the service while the problems then affecting it remained would place health at risk. The following problems were specified: inadequate disinfection; the presence of fecal coliforms in the distribution network; sediment in almost all storage tanks, in most of which chlorine is applied for disinfection, creating a risk of trihalomethane formation, a risk factor for colon, bladder, and rectal cancer; and infrastructure that was in fair condition, with deficiencies in water collection, storage, and distribution. It further stated: “Since 2017, more than 5 sanitary orders have been issued requesting improvements in disinfection and infrastructure, water-quality control plans, and replacement of the distribution network. Due to noncompliance with the sanitary orders, a criminal complaint for disobedience of authority was filed with the Fiscalía de Flores against the Alcalde, Consejo Municipal, and the official responsible for the water-supply system.
Furthermore, since 2018, the intervention of A y A, as the water governing authority, has been requested in relation to that water-supply system; that institution continues with that process and issued official communication PRE-2019-00824. Meetings have been held both with municipal personnel and with the presidency and technical team at both the regional and central levels. (...) Does the remedial plan (plan remedial) remedy the situation? As a result of the intervention being carried out by Acueductos y Alcantarillados in the municipal water-supply system, in diciembre de 2018 a schedule of improvements to be performed over a period of 5 years was prepared. It provides for immediate measures, such as improvements to water disinfection and potability, as well as medium- and long-term improvements, such as infrastructure improvements. The Municipalidad de Santa Bárbara has not complied with that schedule.
The Municipalidad was even asked whether it had the necessary budgetary appropriation to comply with the plan submitted, and its response was unclear on that point; it was therefore determined that compliance with the plan was not assured. (...). Has the regulated party made improvements at the critical points? Improvements have been made to the disinfection systems and to certain collection and storage tanks; however, the improvements are not effective. The sampling results show that the water is not potable, adequate disinfection levels have not been achieved, and fecal coliforms are present in some sectors of the distribution network. Conclusions. According to the instrument, the score is 12. Closure (clausura) is not warranted.
The record shows that this Dirección de Área Rectora de Salud has undertaken all types of interventions aimed at improving the quality of the water supplied to the population of Santa Bárbara, including (...); however, the expected results are not what the population deserves, to the point that after one (sic) two years, the canton’s water has still not been made potable, thereby placing health at risk. Therefore, and in accordance with the foregoing, an analysis of the Technical Rule (Regla Técnica) is being conducted to determine what other extraordinary measures may be pursued in this regard.” (Images 640 to 643 of the judicial case file). It must be reiterated that, despite these assertions, nothing in the document identifies or specifies anything regarding the situation of the Amapola system; quite the contrary, on 21 de agosto del 2019, under the terms of official letter N° MS-DRRSCN-DARSSB-912-2019, dated by the Dirección Área Rectora de Salud de Santa Bárbara, Dirección Regional de Rectoría de la Salud Central Norte del Ministerio de Salud and identified as N° 21 de agosto del 2019, addressed to what was identified as the “Comité de Vecinos de Calle Amapola,” they were informed, in relevant part, as follows: “According to the latest operational water-quality report submitted by the Municipalidad de Santa Bárbara on 3 de junio del 2019, the water-supply system (sistema de abastecimiento) that depends on the Amapola Spring (Naciente Amapola) complies with the Reglamento para la Calidad del Agua in the first-level analysis (Nivel primero, N1), which includes pH, conductivity, turbidity, apparent color, temperature, odor, and the presence of residual chlorine between 0.3 and 0.6 mg/L.
No presence of fecal coliforms or E coli was reported at the spring, storage tank, or distribution network, as may be seen in report N° AG-134-2019 prepared by the Laboratorio de Análisis Ambiental de la Universidad Nacional on 12 de marzo del 2019. It is further reported that between 18 and 20 de junio de 2019, the Instituto de Acueductos y Alcantarillados conducted water-quality sampling in the distribution network of the Amapola system. The sampling showed noncompliance with water-disinfection requirements because residual chlorine levels were below the recommended limits; no presence of fecal coliforms or E coli was reported in the distribution network. Regarding the inquiry concerning report CN-ARS-SB-1241-2017, it is reported that said report concerns the water-quality analyses for the first half of 2017; that report states that residual chlorine levels were below those recommended and that fecal coliforms were present at the spring, storage tank, and distribution network.
The water was therefore considered non-potable because it did not comply with the Reglamento para la Calidad del Agua Potable. Attached is a summary table for the most recent five-year period regarding the presence of residual chlorine and fecal coliforms in the Amapola System:

The results regarding water quality, indicating that the water was potable prior to the filing of the claim adjudicated under the terms of this judgment, are not only conclusive but are also corroborated by the assessment of the Ministry of Health itself, in the exercise of its functions and within its area of expertise. This situation has remained unchanged, since, at least as of 30 de octubre del 2019, the quality of the tablets used to disinfect the relevant aqueduct systems complied with the international regulations then in force, according to a memorandum of that date sent by “Uen Producción y Distribución Gam” to the Presidencia Ejecutiva, both part of AyA (image 705 of the judicial case file); and in noviembre del año 2019, AyA prepared a water-quality report on the aqueducts operated by the Municipality sued herein.
Three water samples were taken from the distribution network of each of the aqueducts administered by the Municipality and were subjected to microbiological testing for indicators of fecal contamination, specifically the detection of thermotolerant coliforms (fecal coliforms) and Escherichia coli, as well as residual chlorine. The following relevant result was also recorded: date: 05/11/2019; sector: El Roble Santo Domingo de Santa Bárbara; samples: Liceo El Robe, Delegación Policial, Ferretería Acosta; free residual chlorine (mg/L): 0.07 for the test samples taken at Liceo El Robe and Delegación Policial, and 0.19 for the location identified as Ferretería Acosta; absence of fecal coliforms and E. coli, representing 96% compliance with microbiological water-quality standards; nevertheless, residual chlorine below the established minimum range was detected. (Images 706 through 739 of the judicial case file).
To conclude with respect to these facts, which we consider relevant, at least as of 15 de abril del 2021, AyA continued its intervention or, as applicable, monitoring of and assistance to the municipal aqueduct and the implementation of a remedial plan. In particular, it monitored matters related to water quality, financial resources and the procurement of goods and services, infrastructure improvement work and component maintenance, as well as what was identified as a contingency plan and communications protocol. In connection with these matters, it is stated that the Municipality sued herein has undertaken efforts effectively aimed at the comprehensive improvement of the aqueduct. (Images 971 through 1002 of the judicial case file, containing the text of the document issued by AyA entitled “Report on the intervention process pursuant to Board of Directors Agreement N° 2020-185 (health order N° 236-2018) and response to the request of the Sala Constitucional de la Corte Suprema de Justicia, in response to the amparo proceeding, case file 20-011545-0007-CO”).
Finally, according to official letter N° ACMSB-021-2022 dated 17 de febrero del 2022, issued by the Administrator of the aqueduct administered by the defendant Municipality, the following pertinent statement was made by way of conclusion: “The fact that a spring (naciente) is geographically located at a particular point does not mean that it will supply only that sector. This is the case with the Amapola spring, which supplies not only El Roble but also the communities of: (...) Calle Amapola, Cuesta Los Patos, San Bosco de Purubá, Zetillal de Santa Bárbara, Calle Potrerillos en Santa Bárbara. (...) It must be taken into account that the Municipalidad de Santa Bárbara improved a substantial part of the Amapola system and installed water meters by obtaining a significant loan. To date, the issues concerning AyA’s health intervention and the health orders of the Ministry of Health have been resolved through significant efforts, as reflected in all the reports and determinations issued by AyA and the Ministry of Health.” (Images 1110 through 1124, of which the information specifically contained in image 1123 is relevant—as will be seen).
Having stated all of the foregoing, with regard to the relief sought—an order requiring AyA to assume or undertake the administration and operation of the relevant aqueduct, solely with respect to one of its 21 systems, namely the system known as “Amapola,” in all that it comprises—the plaintiff has made no argument in that regard, and its theory of the case is not premised on AyA’s adoption of an omission inconsistent with the legal system. Nor did the claimant assert that a request had been submitted to AyA in administrative proceedings (sede administrativa) for it to assume the administration and operation of this system, resulting in the issuance of an administrative act (acto administrativo) rejecting that request and being challenged in the present case. Instead, what is sought is simply that this Judicial Authority issue such an order, specifically based on what the claimant contends has been established: that the service provided to the community of El Roble de Santa Bárbara contravenes the governing principles of continuity, efficiency, adaptability, and equal treatment of its recipients, users, or beneficiaries.
This Court considers it fruitless or unnecessary to analyze and, consequently, to rule on whether it was established that this service is provided discontinuously or without equal treatment of users. It is sufficient to note that neither facts nor lines of argument to that effect were set forth in the complaint, and therefore neither issue was the subject of the dispute.
On the other hand, we have already indicated that the case must be decided through the direct application of Article 2, subsection g) of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados. Accordingly, what would have to be established in order to conclude that the relief sought is warranted is that the service provided is inefficient and, once that point has been established, that it is advisable for AyA to assume its administration and operation, and that such advisability is not constrained by budgetary considerations. The central issue therefore concerns exclusively the efficiency of the service, which could also be associated with the principle of adaptability. From this perspective, we consider it necessary to determine which technical and/or scientific conditions must be present in order to find that a service of this kind is inefficient, since it is not within the Judges’ field of expertise to draw conclusions based on deductions concerning that matter.
According to the Diccionario de la Lengua Española, efficiency means “1. f. The capacity to have someone or something available in order to achieve a particular effect. / 2. f. The capacity to achieve the desired results using the fewest possible resources.” (Emphasis not in the original). The breadth of the term is beyond question. Thus, we consider it one thing to state that an aqueduct system is operated with deficiencies, even if there are many, and quite another to be in a position to assert, from a technical or scientific standpoint, that those deficiencies necessarily lead to the conclusion that the service is inefficient to such a degree that the Municipality should lose its administration and operation. Expert evidence (prueba pericial) in this regard—that is, evidence specifying, with at least a minimum degree of rigor and specificity, the particular reasons and conditions on the basis of which a service of this type may be classified as inefficient—was absolutely necessary, whereas the evidence introduced into the proceedings is not conclusive in that regard. This is where the position taken by AyA during the trial proceedings becomes relevant, since AyA opposes this claim.
None of the parties has referred to any regulations, if they exist, defining the scope of the aforementioned Article 2, subsection g). This Court therefore devoted time to locating such regulations, without success. For that reason, and in the absence of evidence on the matter, we have determined as an unproven fact the existence of technically and/or scientifically verifiable parameters that must be present or are necessary to determine that a potable-water supply service is inefficient. Following this line of reasoning, although it would have been desirable for there to be an administrative act adopted by AyA, regulations promulgated by it, or, as applicable, an argument explaining or elaborating on the foregoing—or explaining the circumstances on the basis of which AyA has even considered internally assuming this aqueduct system—the fact remains that, considering its defense arguments and the evidence as a whole, and entirely irrespective of the reasons that led it to “intervene” in the relevant aqueduct as a whole, AyA instead determined, and has conducted itself accordingly within what we understand to be its discretion in this regard, to exercise its authority as the governing entity of this sector in order, within its sphere of competence, to direct the conduct of the defendant Municipality toward correcting the system’s deficiencies in procedures, infrastructure, and sanitation, without prejudice to the concurrent authority of the Ministry of Health in the latter area. Nor has the plaintiff directed its theory of the case toward challenging whether this administrative position adopted by AyA is consistent with the legal system.
It bears repeating that Article 2, subsection g) of the Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados, together with the remaining subsections of that statutory provision, grants AyA considerable discretion in this regard. The inefficient provision of the service is not, by itself, sufficient for AyA to assume the administration of an aqueduct system; instead, AyA is authorized to weigh such a decision on the basis of advisability and budgetary considerations. Specifically, subsection b) of this Article 2 provides that AyA has authority to determine the priority, advisability, and feasibility of the various projects proposed, among other things, to renovate, expand, or modify aqueduct works, which may not be carried out without its approval. Thus, the decision not to remove an aqueduct system from a municipality’s sphere of action and instead, as in this case, to provide assistance in its capacity as governing entity in order to promote the system’s comprehensive improvement—which is what has been occurring in this particular case—not only finds support in this provision, but is also an issue that is not disputed in the present judicial proceeding, simply because the plaintiff did not propose it as a subject of dispute.
Furthermore, in addition to everything stated up to this point, because this latter administrative position actually adopted by AyA has not been challenged by the plaintiff, and the plaintiff has not argued why arbitrariness, rather than discretion, existed under the rules of science and/or technical expertise, this Court is not procedurally positioned to conduct an analysis in that regard.
It is for these reasons that this Chamber cannot find that AyA’s implicit—because it is not express—or, as the case may be, formal and substantive omission to assume the administration and operation of the water-supply system identified as Amapola is contrary to law. Nor can it find unlawful the decision that does emerge clearly from the evidence: to assist the defendant Municipality in a process of improving the water-supply system across its 21 systems and, consequently, the drinking-water supply service provided. The plaintiff must also be advised that this process, which was termed an “intervention,” began before the filing of its complaint and has been programmatic in defining various actions, all aimed at correcting the technical and sanitary deficiencies affecting the system. This explains why the Municipal representatives have endeavored to demonstrate both the progress made in this process and the current condition of the water-supply system as a whole, and of the Amapola system specifically.
If the matter concerns expediency, pursuant to Article 2(g) of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, this is a relevant consideration. It should be noted in this regard that, given how the issue of disinfection evolved in terms of water quality, before the plaintiff filed suit the matter of the presence of fecal coliforms and/or E. coli had been resolved in compliance with the “Reglamento de la Calidad de Agua Potable.” This is without prejudice to the fact that adjustments concerning residual chlorine (cloro residual) were still required in only part of the water-supply system to ensure the water’s safety; in any event, the water was determined to be potable, including the water originating from the Amapola system. In this respect, this Court does not consider conclusive the content or scope of the two expert reports submitted by the plaintiff, which were prepared at the time by Engineer Fernando Sánchez Redondo.
Those reports address aspects related to the water-supply infrastructure that, in his opinion, led him at the time to conclude that the system had collapsed. This must be weighed against the rule contained in the repeatedly cited Article 2(g), as well as the remaining subsections of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, since there has clearly been some subsequent progress in this regard under AyA’s oversight and the monitoring of the Ministerio de Salud. Furthermore, the issue relating to water quality has been successfully resolved, notwithstanding that, in his sworn testimony during the supplemental public oral trial hearing, he stated that he had visited the site of the Amapola springs (nacientes) and that problems which, in his professional opinion, had not yet been resolved and which had been identified when his expert reports were prepared posed a risk of contamination.
This compels the conclusion that, as regards the quality of the service in terms of water quality, the service is efficient. It is now also clear that, because continuity of service was not an issue in dispute, it cannot be found that this principle has not been satisfied; the same is true of the principle associated with providing the service on an equal-treatment basis to users. The remaining issue would be the service’s adaptation to change, which could indeed be associated with efficiency, an aspect that has been addressed since 2019 and continues to be addressed to date. In any event, it bears repeating that whether, on the basis of this final residual point, the service should be classified as inefficient was not established through expert evidence. Moreover, even if it had been established, three issues remained that were not even the subject of debate: expediency and budgetary considerations, as well as whether the adoption of a particular administrative action (conducta administrativa)—within the discretion enjoyed by AyA as a Public Administration—consisting of assisting with an apparently long- or medium-term improvement process instead of directly taking over the water-supply system, was consistent with the legal system.
In view of all the foregoing, the claim for relief identified as “b” must be declared inadmissible; consequently, claim “c” must meet the same fate and is likewise declared inadmissible. The complaint is therefore dismissed in its entirety. With respect to the remainder of the documentary evidence contained in the physical record, as well as the trial testimony given by María Antonieta Acuña Hernández, having reviewed that evidence, we find that it provides no basis for this Chamber to rule otherwise.-
VIII.Regarding the defenses raised. In its defense, the representative of AyA raised exclusively the defense of lack of a legal right (excepción de falta de derecho), while the representative of the defendant Municipality raised, in addition thereto, the defense of lack of standing (excepción de falta de legitimación activa). With respect to the defense of lack of standing, it is denied; it is sufficient to inform the Municipality’s representative that, whether or not it specified this in detail, the plaintiff Association brought this action in defense of the collective interests (intereses colectivos) of the residents who, as members thereof, believe that their rights or legitimate interests have been infringed through the provision of a municipal public service. Accordingly, they cannot be deemed to lack standing to bring the action as they did in that respect, which is what is relevant. On the other hand, regarding the defense of lack of a legal right raised by both defendants, it is sufficient to refer the parties to the analysis contained in the body of this judgment, as the plaintiff Association has no legal right to obtain all of the relief sought in its entirety.-
IX.Regarding costs. Pursuant to section 193 of the Código Procesal Contencioso Administrativo, procedural costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed on the unsuccessful party by virtue of having lost. Nevertheless, applying subsection b) of the aforementioned article, we find that, given the nature of the issues in dispute in this case, there was sufficient reason to litigate. Therefore, this judgment is issued without a specific award of costs (especial condenatoria en costas).-
POR TANTO
Of the evidence offered to assist the court in reaching its decision (prueba para mejor resolver) by the representative of the defendant Municipality, the Court admits exclusively all the evidence offered in the written submission filed with the court on 13 de enero del 2020, as well as the judicial case-file images numbered 971 through 990 and images 1110 through 1124; the remaining evidence is denied. The defense of lack of standing raised by the defendant Municipality is denied. The defense of lack of a legal right raised by both defendants is sustained and, consequently, because the action is unfounded with respect to all relief sought, it is dismissed in all respects. Intervienen, como apoderados especiales judiciales de la Municipalidad demandada, Juan Carlos Medrano Cubero, cédula de identidad N° 1-1402-0502; María Leonor Anchía Cascante, cédula de identidad N° 1-1073-0995; David Gerardo Salazar Morales, cédula de identidad N° 4-0208-0596 y Rolando Alberto Segura Martínez, cédula de identidad N° 1-0625-0122 y como apoderado especial judicial del AyA, Víctor Manuel Soto Piatkina, cédula de identidad N° 1-1342-0557.-
RESULTANDO:
Redacta el juez Córdoba Ramírez y se resuelve por unanimidad.-
CONSIDERANDO
I.Sobre la prueba ofrecida para mejor resolver. A título de prueba para mejor resolver, la representación municipal solicitó por escrito presentado a estrados judiciales el día 13 de enero del 2020, lo siguiente: "1. Copia certificada de análisis de agua emitidos por el Instituto Nacional de Acueductos y Alcantarillados, así como de la Escuela de Ciencias Ambientales de la Universidad Nacional de Costa Rica; 2. Copia certificada de inicio de labores para la instalación de medición para el Acueducto Municipal; 3. Copia certificada del inicio de labores para la instalación de medición para el Acueducto Municipal; 4. Copia certificada del expediente de la Licitación Abreviada N° 2019LA-00004-CL "Mantenimiento y obras complementarias (Obra Pública) en los tanques y las nacientes del Cantón de Santa Bárbara"; 5. Copia certificada del expediente de la Licitación Abreviada N° 2019-LA00005-CL "Impermeabilización de tanques de almacenamiento de agua para consumo; 6.
Copia certificada de la Actualización del Plan Maestro del Acueducto Municipal". Luego, en los términos de otro escrito, esta vez presentado a estrados judiciales el día previo a la celebración de la audiencia complementaria en horas no laborales, a saber, el 09 de enero del 2024, se formuló solicitud para que se admita en este mismo carácter, un sinnúmero de documentación que se explicó durante la celebración de tal audiencia oral, que se encuentra dirigida a demostrar el estado actual de las cosas en relación al acueducto de interés, que comprende 263 imágenes del expediente judicial y que por la extensa cantidad de documentos no pasamos a especificar. Además, se ofreció también como prueba para mejor resolver, la declaración de quien se identificó como el señor David Cortés Sánchez y Harold Chaves Montero según lo entiende este Tribunal, con el mismo propósito que la pruebas documental anterior, sobre la que se indicó a las partes que el respectivo pronunciamiento sobre su admisibilidad de ser rechazada, se habría de hacer en sentencia.
Sobre el particular, no está por demás recordar que, en cuanto a la prueba para mejor resolver de corte documental efectivamente de obligada aplicación deviene lo dispuesto en el artículo 50 del Código Procesal Contencioso Administrativo. Por otra parte, también resulta relevante advertir que conforme el actualmente vigente texto del Código Procesal Civil, lastimosamente en técnica legislativa se omitió regular este instituto de la prueba para mejor resolver, siendo que conforme el texto de este cuerpo normativo derogado, su artículo 331 regulaba con suficiencia y claridad, lo propio. En el actualmente vigente Código Procesal Civil, lo único al respecto regulado lo es en los términos de la admisión de la prueba oficiosa conforme lo dispuesto en su artículo 41.3. que claro está, podría serlo y de hecho en algunos casos lo será, para mejor proveer. Luego y de todas formas, estimamos que ha de observarse que siendo conforme uno u otro cuerpo normativo la prueba para mejor proveer, del Juez y no de las partes, pese a que la ofrezcan o no, que su rechazo no habría de producir por suerte de automatismo racional, indefensión y en consecuencia, un vicio sustancial por indefensión.
(Sala Primera de la Corte Suprema de Justicia N° 547-F-2002 de las 16:00 hrs. del 12 de julio de 2002; N° 29-1995 de las 15:30 hrs. del 22 de febrero de 1995; N° 290-F-S1-2009 de las 10:30 hrs. del 20 de marzo de 2009). Por otro lado, el ordenar o no prueba de este tipo supone algún límite impuesto el Juzgador, en el entendido de que por este medio no se ha de suplir el deber procesal que sólo incumbe a quien demanda o es demandado en el sentido de que es su deber ofrecer la prueba de su interés en el momento procesal oportuno. (Sentencia de la Sala Primera N° 001439-F-S1-2014 de las 09:25 horas del 07 de noviembre de 2014). No puede en consecuencia el Juez en su búsqueda de la verdad real, so pena de vulnerar otros principios igual rango o jerarquía procesal que deben de encontrarse en equilibrio, ordenar prueba para mejor proveer cuando de ello se derive inevitablemente una sustitución de los mecanismos ordinarios de defensa con que cuentan quienes se encuentran vinculados en la relación jurídico procesal y mandados a probar por virtud de su situación dentro de tal relación procesal.
Lo contrario salvo en contadísimas y excepcionales circunstancias que habrían de encontrarse debidamente acreditadas y razonadas, así como amparadas en intereses superiores particularmente en asuntos en los que medien intereses públicos calificados o reforzados por su importancia, conllevaría fácilmente a cuestionamientos sobre el ajuste de la actuación del juez con el deber de observar objetividad e imparcialidad en mantenimiento del equilibrio procesal entre las partes, pero también importaría un patrocinio inadmisible en favor de quien no habiendo usado en forma debida y/o en tiempo su derecho y deber de probar por negligencia, descuido o una intención de obtener una ventaja procesal indebida en uso abusivo y/o antisocial de su derecho, pretende por esa vía subsanar una omisión procesal que es exclusivamente resorte suyo evitar cuando debió serlo, en este sentido. (Ver artículos 21 y 22 del Código Civil y el fallo de la Sala Primera en su sentencia N° 794-2006 de las 03:35 hrs. del 20 de octubre de 2006, que reza así en lo conducente: "...
Por otra parte, es menester indicar que no es oportuno intentar mediante el ofrecimiento de probanzas que debieron aportarse y evacuarse en la etapa procesal correspondiente, abrir de nuevo el debate. Darle cabida a esta petición significaría que las partes estén en la posibilidad de subsanar sus omisiones respecto de la prueba que pudieron haber ofrecido en su oportunidad y no lo hicieron. Por otro lado, tampoco resulta posible acceder a ampliar la declaración de dos testigos, porque de igual forma sería enmendar su incuria"). No está demás recordar que alguna parte de la doctrina insiste en que, el Juez debe proceder "(...) con suma cautela, porque es indudable que una diligencia practicada en esas condiciones puede perjudicar siempre un derecho que de otra manera se habría beneficiado con la instrucción defectuosa y es necesario, entonces, que su imparcialidad no se comprometa, cuidando de que en ningún momento se le atribuya la intención de suplir la negligencia de alguna de las partes" (Alsina.
Hugo (1956). Tratado Teórico Práctico de Derecho Procesal Civil y Comercial. Tomo I. Buenos Aires, p. 445). Dicho todo lo anterior, por estimar esta Cámara únicamente la prueba que se dirá dados los términos en que habrá de ser fallado el presente asunto, se admite exclusivamente la siguiente: primero; la totalidad de la prueba ofrecida por escrito presentado a estrados judiciales el día 13 de enero del 2020; segundo, de la aportada con el escrito presentado a estrados judiciales el día 09 de enero del 2024, exclusivamente la que sigue: la comprendida a imágenes -todas del expediente judicial- que van de la 971 a la 990 en que obra el texto del documento emitido por el AyA denominado "Informe del proceso de intervención según acuerdo de Junta Directiva N° 2020-185 (orden sanitaria N° 236-2018) y de respuesta a lo solicitado por la Sala Constitucional de la Corte Suprema de Justicia, en respuesta al recurso de amparo expediente 20-011545-0007-CO"; así como las que van de las imagen 1110 a la 1124, de la que resulta de relevancia la información -como se verá- específicamente comprendida en la imagen 1123, en lo que se relacionan las comunidades que son abastecidas a partir del agua obtenida de la naciente "Amapola", dentro del Cantón de Santa Bárbara. La restante prueba documental, así como la testimonial o testimonial pericial de los señores David Cortés Sánchez y Harold Chaves Montero, por estimarla este Tribunal innecesaria, se rechaza.-
II.Sobre los reproches formulados por la parte actora. Indicó quien demanda en soporte argumentativo de su acción lo siguiente: "Primero. Que la Asociación que represento es propietaria de la finca inscrita en el Registro Nacional, Partido de Heredia matrícula 146587-000, la cual fue adquirida dada su importancia social en tanto se ubican en ella las nacientes de agua del distrito de El Roble de Santa Bárbara, provincia de Heredia, denominadas nacientes Amapola, que abastecen aproximadamente 896 casas y una población de cercana a los 2754 habitantes. Prueba. Se adjunta certificación del inmueble de Heredia matrícula 146587-000 (RNPDIGITAL-10077384-2018). (...). Segundo. Que toda la infraestructura de distribución y almacenamiento de agua fue construida por los habitantes del distrito del Roble, asimismo la administración del acueducto fue asumida por ellos mismos, no obstante, hace aproximadamente 20 años, la Municipalidad de Santa Bárbara asumió la dirección y gobierno de dicho acueducto, sin mediar el traspaso del inmueble especificado en el hecho anterior.
(...). Tercero. Que durante el tiempo que ha transcurrido desde la asunción municipal del acueducto hasta la actualidad, el servicio prestado a devenido en pésimo, por cuanto se ha omitido toda inversión planificada para ajustar el servicio al crecimiento y necesidades de la población usuaria; todo lo cual ponemos de manifiesto en los hechos que siguen. (...). Cuarto. Que en el memorando OPT-EYP-00-335 de 20 de octubre de 2000, cursado entre dependencias de INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, se anexa el documento denominado Evaluación Acueducto del Roble de Santo Domingo, Santa Bárbara de Heredia, documento elaborado, según indica, porque una agrupación de vecinos del Roble se presentó ante la Presidencia Ejecutiva del Instituto indicado, para solicitar que dicho Acueducto fuera intervenido, dado que consideraban “que la Municipalidad no lo atiende como es debido y el mantenimiento es pésimo así como la calidad del agua”.
En esta evaluación se concluye sobre la necesidad de varias obras de infraestructura, entre ellas la sustitución de las tuberías, lo cual a la fecha no se ha realizado. (...). Quinto. Que según consta en el oficio UPC-CAH-01507-01 de 30 de octubre de 2001 del Proceso de Control del Ambiente Humano a la Dirección de Central Norte - Heredia, ambas dependencias del Ministerio de Salud: “Nuestro Proceso de Control al Ambiente y el Área de Salud de Santa Bárbara conjuntamente se procedió al muestreo puntual para verificar la calidad bacteriológica y sanitaria del agua de consumo. Se detectan dos puntos positivos por Coliformes fecales (fuentes y red)”. (...). Sexto. Que en este último documento, también se recomienda al Concejo Municipal de Santa Bárbara “el traspaso del Acueducto considerando los artículos: 2, 3 y 4.1, Capítulo 1 del Reglamento de las Asociaciones Administradoras de los Servicios de Acueductos y Alcantarillados (Decreto 29100-S)”.
(...). Séptimo. Que se indica en el oficio UPC-CAH-AMM-796-03 de 06 de noviembre de 2003 de la UNIDAD DE PERMISOS Y CONTROLES del Ministerio de Salud, que: “El resultado de análisis bacteriológico sanitario revela: / El Roble: Abastecido por La Amapola con una densidad promedio de Coliformes Fecales en los puntos de muestreo”. (...). Octavo. Que el 16 de noviembre de 2011 se emite orden sanitaria por parte del Área Rectora de Salud de Santa Bárbara, retomando un aspecto incumplido reiteradamente en el pasado, se trata de la orden sanitaria 105-2011, por la distancia o retiro de viviendas respecto a las nacientes. (...). Noveno. Que se indica en el oficio CN-ARS-SB-1011-2012 de 05 de julio de 2012 del ÁREA RECTORA DE SALUD SANTA BÁBARA del Ministerio de Salud señala, luego de constatar varias inconformidades: “De acuerdo a la inspección realzada a la naciente y en el tanque de almacenamiento del acueducto de Santo Domingo del Roble, se debe dar mantenimiento y un control en las nacientes conforme a las normativas existentes.
Realizar los trabajos necesarios en la periferia de la naciente y darles continuidad como la protección perimetral para evitar en ingreso de personas ajenas a las tomas de agua y evitar el ingreso de aguas superficiales al interior de los tanques de captación mediante la construcción de cunetas. / Es indispensable realizar limpieza general en la naciente, gestionar ante quien corresponde se amplié el área de protección de la naciente. Se coloquen sistemas de cierre seguro en las tapas mediante candados u otros de mayor seguridad”. Se emite adicionalmente la orden sanitaria N° 51 -2012. (...). Décimo. Que mediante oficio DAC-MSB-548-2012 de 27 de julio de 2012 la ingeniera encargada del acueducto municipal informa a la Alcaldía de Bárbara que se realizaron las labores de limpieza ordenadas en el hecho anterior, pero que referente “a los cuidados con el naciente le informo que de acuerdo al presupuesto extraordinario estaremos haciendo lo posible para incluir la Naciente Amapola en el listado para “Mejoras de las Nacientes” ya que contamos con varias tomas de agua que se encuentran en pésimo estado y urge mantenimiento con los dineros del presupuesto extraordinario que no es mucho para tantas nacientes”.
(...). Undécimo. Que en el oficio CN – ARS – SB – 638 – 2013 de 13 de mayo del 2013, documento de seguimiento de la orden sanitaria 51-2012, se constata el incumplimiento de dicha orden sanitaria y en general la falta de mantenimiento del acueducto. Se indica en este documento que se procederá a presentar denuncia penal. (...). Duodécimo. Que en oficio CN–ARS–SB–902–2013 de 24 de junio del 2013 del ÁREA RECTORA DE SALUD DE SANTA BÁRBARA a la DIRECCIÓN REGIONAL DE RECTORÍA DE LA SALUD CENTRAL NORTE, ambas dependencias del Ministerio de Salud: “En la inspección realizada se observa incumplimiento de orden sanitaria emitida N° 51–2012, donde se observan irregularidades en la protección perimetral y el mantenimiento de los acueductos”. (...). Decimotercero. Que ante la gravedad de la situación con el acueducto y la acumulación de evidencia por tantos años, mi representada la ASOCIACIÓN DE DESARROLLO INTEGRAL DEL ROBLE DE SANTA BARBARA DE HEREDIA, solicitó a la empresa Ingenieros Consultores y Ejecutores de Acueductos S.A., la elaboración de un estudio sobre el acueducto de El Roble, mismo que fue rendido por el Ingeniero Fernando Sánchez Redondo, código IC 5002, quien arribó a la siguiente conclusión el 12 de julio de 2013: “El sistema inspeccionado se encuentra en gran medida colapsado técnica, sanitaria y operativamente, en perjuicio de toda la comunidad del Roble de Santa Bárbara, por lo que requiere de atención inmediata y urgente”.
(...). Decimocuarto. Que en el oficio CN-ARS-SB 1115-2014 de 26 de agosto del 2014 de la DIRECCIÓN ÁREA RECTORA DE SALUD DE SANTA BÁRBARA formula ante la Fiscalía de Flores denuncia por contaminación ambiental contra el jerarca de la Municipalidad demandada por haberse hallado nuevamente no conformidades constatadas el 14 de mayo de 2014, que ponen en riesgo la calidad del agua del acueducto La Amapola, así como el incumplimiento de la orden sanitaria 10-2014 de 20 de mayo de 2014. (...). Decimoquinto. Que en oficio del 11 de febrero de 2016 el entonces Alcalde de la Municipalidad demandada señor Melvin Alfaro Salas, hizo un planteamiento al instituto demandado para que esa entidad interviniera el acueducto de esta comunidad. Ese documento fue acuerpado por la Asociación actora y presentado a aquel Instituto el 22 de abril de ese año, lo cual no obtuvo ninguna respuesta, por lo que obligó a la presentación de un recurso de amparo que produjo la sentencia favorable 2017-020135 de 9:20 horas del 15 de diciembre de 2017, que ordenó “se realicen los estudios pertinentes para garantizar la calidad del agua del acueducto denunciado y resolver la gestión de intervención del acueducto presentada por la Asociación amparada …”.
(...). Decimosexto. Derivado de la sentencia y gestiones administrativas de la Asociación actora, procedió el Instituto demandado a esbozar un conato de trabajo en esa dirección lo que a la postre fue de resultado infructuoso tanto por la posición de la Corporación demandada como por la falta de ejecución del ente rector. (...). Decimoséptimo. El alcalde Melvin Salas en esa misma época autorizo la entrega a la Asociación actora de tubos de seis y cuatro pulgadas para sustituir la de asbesto cemento que se encuentra por una distancia de unos 800 metros en la red de distribución del agua. La Asociación actora trasladó y colocó esos tubos asumiendo la totalidad de los costos, sin embargo, hicieron falta unos 5 o seis tubos de seis pulgadas para poder sustituir la de asbesto cemento. Se gestionó al Municipio y muchas ocasiones para conectar esa tubería sin resultado posible. La nueva tubería tiene ya casi tres años de estar enterrada sin uso.
(...). Decimoctavo. Que en el oficio CN-ARS-SB-241-2017 de 3 de marzo del 2017 de la DIRECCIÓN ÁREA RECTORA DE SALUD SANTA BÁRBARA analiza los resultados del Reporte AG-765-2016 sobre la calidad del agua de 30 sistemas administrados por la Municipalidad de Santa Bárbara, resultando deficiencias en todos ellos, y en lo que respecta al acueducto Amapola, resultó clasificado como de Muy Alto Riesgo, en tanto, se detectó la presencia de coliformes fecales y E. Coli en el tanque de almacenamiento o Red y el cloro residual no alcanza los niveles de desinfección adecuados o no fue detectado. Asimismo, se emitió la orden sanitaria N° 242-2017. (...). Decimonoveno. Que mediante la sentencia de la Sala Constitucional 2017009566 de 9.45 horas de 23 de junio de 2017 se declaró con lugar amparo contra la Municipalidad demandada por incumplimiento de la orden sanitaria que se acaba de indicar y también por incumplimiento de la orden 497-2017.
(...). Vigésimo. Que en oficio CN-ARS-SB-986-2017 de 29 de setiembre del 2017 de la DIRECCIÓN ÁREA RECTORA DE SALUD SANTA BÁRBARA del Ministerio de Salud, en acatamiento de sentencia citada en hecho anterior y la orden sanitaria 242-2017, encontró que esta última estaba parcialmente cumplida. (...). Vigésimo primero. Que en oficio CN-ARS-SB-1241-2017 de 16 de noviembre del 2017 de la DIRECCIÓN ÁREA RECTORA DE SALUD SANTA BÁRBARA del Ministerio de Salud, analizando el reporte de muestras de 23 nacientes correspondientes a 17 sistemas de acueductos del cantón, concluye nuevamente que debe clasificarse el sistema como de Alto Riesgo y afirma: “El sistema de abastecimiento de la naciente Amapola es el que se observa con mayor contaminación por coliformes fecales y E. Coli. Ya que presenta contaminación tanto en tanque de almacenamiento y en los tres niveles de la red de distribución además de que los niveles de cloro residual son bajos”.
Este informe anterior dio lugar a la emisión de la orden sanitaria 1242-2017 notificada el primero de diciembre de ese año. (...). Vigésimo segundo. Que en informe PRE-2018-00039 de enero del 2018 de la Presidencia Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados: “Que se le indica a la Municipalidad de Santa Bárbara que realicen mejoras para el acueducto Amapola en cuanto al sistema de tuberías y repartición del líquido, a realizar presupuestos sobre las mejoras de esta, y a realizar estudios sobre el alcantarillado, el tanque y naciente”. (...). Vigésimo tercero. Que se indica en Acta de Inspección a las nacientes Amapola de 29 de mayo del 2018, entre otros: “Que el tanque está mal estructurado, el mantenimiento de este no es el adecuado, que el lote donde se encuentra la naciente no es de la Municipalidad de Santa Bárbara de Heredia, y carece de seguridad perimetral”.
(...). Vigésimo cuarto. Que en acatamiento a la Sanitaria N° 236-2018 el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, elaboró un informe sobre la totalidad de acueductos de la Municipalidad demandada en el que se señala todas las deficiencias que estos presentan, la situación jurídica de estos, los trabajos que deben hacerse, planos constructivos para esas obras y la necesidad de cronogramas de trabajo por parte de la accionada. En ese informe entre otras omisiones se encontraron coliformes fecales en el acueducto de esta comunidad. Se señala también: “En cuanto a los tanques de reunión de las nacientes y tanque de almacenamiento amapola, carecen de cloración de aguas, mantenimiento, limpieza y acceso a los tanques, no tienen rotulación de prevención, ni seguridad perimetral”. (...). Vigésimo quinto. Que dando seguimiento y corroborando la situación peritada a instancia de mi representada según lo indicado en el hecho 13 anterior, nuevamente se solicitó a la empresa Ingenieros Consultores y Ejecutores de Acueductos S.A., la elaboración de una actualización del estudio sobre el acueducto de El Roble, mismo que fue nuevamente rendido por el Ingeniero Fernando Sánchez Redondo, código IC 5002, quien arribó a la siguiente conclusión el 07 de marzo de 2019: “En síntesis, como consultor, considero que este sistema en general tiene una serie de debilidades estructurales y sanitarias, incumpliendo con las normas establecida para el abastecimiento de agua potable, en perjuicio y riesgo de la salud y calidad de vida de la comunidad de El Roble de Santo Domingo de Santa Barbara. / No omito, en manifestar, que, en julio del 2013, en un primer informe, ya había indicado toda esta serie de falencias del sistema y prácticamente, seis años después, persisten los mismos problemas en la operación del acueducto, lo que demuestra por parte del administrador del Sistema, una total falta de atención e interés, además del desconocimiento adecuado en la operación de un sistema de abastecimiento de agua potable.
Es urgente llevar a cabo un Estudio Técnico detallado, que establezca la planificación de las mejoras por etapas de manera lógica y ordenada”. (...). III. TEORÍA DEL CASO, FUNDAMENTOS Y RAZONES DE APOYO. La pretensión que se intenta sea atendida por la Jurisdicción Contencioso Administrativa tiene su razón de ser en la prestación totalmente ineficiente y con grave peligro para la salud, del servicio público de agua potable para la comunidad de Santo Domingo del Roble de Santa Barbara de Heredia. A. PRESENTACIÓN. El acueducto de esta comunidad del Roble de Santa Bárbara fue construido por sus pobladores, desde el nacimiento hasta la red de distribución, todo fue hecho a mano por los fundadores del pueblo. Con el paso de los años y al crecer la población se consideró más atinado que su administración estuviese en manos de la autoridad superior de la comunidad, y por eso se hizo el traslado a la Corporación Municipal.
Aun así, los vecinos preocupados por el futuro de sus fuentes, adquirieron el terreno donde se ubica el nacimiento del agua de la comunidad y con un gran esfuerzo han mantenido durante muchos años su titularidad. El Municipio se ha dedicado por muchos años a solucionar los problemas inmediatos, básicamente la reparación de fugas de agua. Los vecinos en muchas manifestaciones individuales o colectivas han planteado sendos pleitos ante los tribunales (en especial la Sala Constitucional) reclamando un mejor servicio, la protección de salud y reiteradamente la necesidad de intervenir ese servicio. La Sala y más reciente el Instituto de Acueductos y Alcantarillados han dado la razón a la comunidad y en forma más evidente el Ministerio de Salud, que no solo ha indicado la necesidad de que se traspase el acueducto sino que también ha sido de donde han emanado muchas órdenes sanitarias en procura de la corrección de anomalías.
Muchas de ellas repetición en el tiempo de los mismos incumplimientos y desmejoras, que no acaban nunca por ser atendidos en forma incorrecta. Acueductos y Alcantarillados también le ha señalado a la demandada múltiples anomalías y la forma de corregirlas. Le ha pedido a la Municipalidad que se hagan labores planificadas, con cronogramas y hasta planos básicos ha suministrado de las obras que deben hacerse. La Sala Constitucional de su lado ha buscado proteger la salud de los habitantes acogiendo muchos recursos de amparo (los que se citan en los hechos son tan solo una muestra), y en especial al declarar con lugar el que estableció la Asociación actora, le ordenó resolver específicamente sobre la intervención que se reclamó en el proceso. Sin embargo, nada de eso ha dado resultado. La Municipalidad deniega una y otra vez la factibilidad de traspasar el acueducto a una asada y menos al Instituto demandado; Acueductos rehuye decidir una intervención alegando el destino de sus fondos y ajustando su proceder en realidad a un absoluto temor al conflicto.
La Sala Constitucional siempre remite a la vía legal en vista de que el tema no es de solución en su sede. Lo cierto es que la realidad de la situación, muestra un acueducto antiguo, deteriorado, sujeto a una deficiente administración, carente de todo planeamiento, sin sentido de futuro, falto de creatividad, subutilizado y desperdiciado en la totalidad de su infraestructura. La Municipalidad ha esgrimido por muchos años la existencia de un crédito para modernizarlo, lo cual no es más que ficción heredada de una administración a la otra. Duele ver los ríos de agua que se derraman cada vez que las tuberías principales y sus ramales se rompen por su mala calidad o por su antigüedad, el desperdicio de agua en el invierno por falta de tanques de almacenamiento, el deterioro de las zonas aledañas a la naciente (incluida una construcción ilegal en el área de la naciente que el municipio ha tolerado y no ha demolido), y por supuesto la ausencia de una política real que cuide ese recurso y sus fuentes.
La comunidad a través de la Asociación de Desarrollo adquirió el terreno de la naciente, lo cual debería extenderse a otras zonas aledañas habida cuenta de la limitante que en cuanto al uso de suelo impone la legislación, más la falta de liderazgo municipal y la desidia de la población ante el mandato de ésta, impide que se produzca dicha extensión. Aplicando que el hacer es el mejor decir, cada vez que se ha convocado a los pobladores para atender su temática, se asiste masivamente a cuanto evento sea citado por la Asociación. Así se cambió varios cientos de metros de tubería de asbesto cemento por plástica, la cual está en uso. Sin embargo, el mayor tramo de unos 800 metros de asbesto permanece en uso actual, pese a que hace más de tres años la Asociación financió la totalidad de los trabajos de colocación. La tubería allí está, abandonada en la profundidad de la tierra, a apenas unos pocos metros del ramal principal que sustituiría, en tanto los pobladores seguimos consumiendo asbesto cemento a través del agua.
Los mismos tanques de almacenamiento, las mismas tuberías de metal y asbesto cemento, la misma estructura de distribución de hace más de 50 años es la que se mantiene en esta comunidad, contra una población que ha crecido en más del 1000 por ciento. Aquí no hay hidrantes. No hay llaves de paso para impedir las fugas de la tubería principal. No hay una bodega de materiales ni personal disponible para atender el servicio. No hay planos de construcción y ubicación de tanque y tuberías. No hay control de servicios ilegales de agua. No hay discriminación en ese servicio. No hay control de aguas servidas en la naciente. No hay servicios de ningún tipo para el personal cuando trabaja en la naciente. Cero mantenimiento de la naciente y todos los ramales. Cero mantenimiento e identificación de las servidumbres de tuberías. Esta demanda pretende que los juzgadores valoren la urgencia que tenemos como organización social, como representantes de los intereses de nuestra población de disfrutar, preservar y mejorar todo lo relativo al suministro de agua potable.
Que la demandada Municipalidad de Santa Barbara lo retorne a los legítimos interesados, que Instituto demandado asuma la responsabilidad correspondiente en forma directa o a través de las asadas aledañas, para que la administración que se instaure logre la finalidad a la que aspira nuestra población. B. SERVICIO PÚBLICO DE AGUA POTABLE. El Instituto Costarricense de Acueductos y Alcantarillados (AYA), tiene por objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable (art. 1 ley 2726). El Instituto se encarga también de determinar la prioridad, conveniencia y viabilidad de los diferentes proyectos que se propongan para construir, reformar, ampliar, modificar obras de acueductos y alcantarillados, los cuales no se podrán ejecutar sin su aprobación (art. 2 inciso b), asimismo y de la mayor relevancia para este proceso, es responsable de administrar y operar directamente los sistemas de acueductos y alcantarillados en todo el país, los cuales debe ir asumiendo tomando en cuenta la conveniencia y disponibilidad de recursos y que los sistemas que actualmente están administrados y operados por las corporaciones municipales podrán seguir a cargo de éstas, mientras suministren un servicio eficiente (art. 2 inciso g).
Por su parte el Reglamento 32529 de dos de febrero del 2005, denominado Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, establece que el Instituto demandado podrá delegar la administración, operación, mantenimiento y desarrollo de los sistemas de acueductos y/o alcantarillados comunales a favor de asociaciones denominadas ASADAS (artículo tercero). Estas personas jurídicas tendrán como fin la construcción, administración, operación, mantenimiento y desarrollo de los sistemas de acueductos y alcantarillados delegados por el Instituto, así como la conservación y aprovechamiento racional de las aguas necesarias para el suministro a las poblaciones (artículo 16 del reglamento 32529) y en el caso de que tales entidades no garanticen el servicio público, el Instituto podrá asumir de pleno derecho la administración, operación, mantenimiento y desarrollo, con todos sus deberes, obligaciones y patrimonio (artículo cuarto).
C. PRINCIPIOS DEL SERVICIO PÚBLICO. La Ley General de la Administración Pública dispone en su artículo 4, que la actividad de «[…] los entes públicos deberá estar sujeta en su conjunto a los principios fundamentales del servicio público, para asegurar su continuidad, su eficiencia, su adaptación a todo cambio en el régimen legal o en la necesidad social que satisfacen y la igualdad en el trato de los destinatarios, usuarios o beneficiarios». A este respecto la Sala Constitucional ha derivado: “IV.- Sobre el derecho fundamental al buen funcionamiento de los servicios públicos. Esta Sala en su jurisprudencia ha establecido que la Constitución Política recoge un derecho fundamental innominado o atípico, que es el de los administrados al buen funcionamiento de los servicios públicos, que se infiere de la relación de los numerales, interpretados a contrario sensu, 140, inciso 8°, 139, inciso 4° y 191 de la Ley fundamental en cuanto recogen, respectivamente, los parámetros deontológicos de la función administrativa tales como el "buen funcionamiento de los servicios y dependencias administrativas", "buena marcha del Gobierno" y "eficiencia de la administración".
Son ya numerosos los fallos en los que ha dicho que este derecho fundamental al buen funcionamiento de los servicios públicos le impone a los entes públicos actuar en el ejercicio de sus competencias y la prestación de los servicios públicos de forma eficiente y eficaz y, desde luego, la obligación correlativa de reparar los daños y perjuicios causados cuando se vulnere esa garantía constitucional”. Sala Constitucional. Resolución Nº 02923 – 2011. Fecha de la Resolución: 04 de marzo de 2011. Expediente: 10-016393-0007-CO. Clase de Asunto: Recurso de amparo El Reglamento 30413 del 25 de marzo del 2002, Reglamento Sectorial para la regulación de los servicios de acueducto y alcantarillado sanitario, encomienda al Instituto Nacional de Acueductos y Alcantarillados las tareas de planear, financiar y desarrollar de todo lo relacionado con el suministro de agua potable, velando porque los sistemas de acueducto y alcantarillado sanitario cumplan con los principios del servicio público.
Finalmente, de relevancia para el presente caso, resaltamos que el Reglamento 32529, dispone que todos los bienes muebles e inmuebles utilizados en la administración, operación, mantenimiento y desarrollo de los sistemas de acueductos y alcantarillados se consideran de domino público, no se podrá disponer de ellos (artículo 18 y 21 inciso 10). D. DERECHO FUNDAMENTAL A LA SALUD. También la jurisprudencia de la Sala Constitucional ha sido congruente y reiterada respecto al derecho fundamental a la salud: “V.- El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental.
Evidentemente, cualquier retardo de los hospitales, clínicas y demás unidades de atención sanitaria de la Caja Costarricense del Seguro Social puede repercutir negativamente en la preservación de la salud y la vida de sus usuarios. Los entes, órganos y funcionarios públicos se deben a los usuarios con una clara e inequívoca vocación de servicio, puesto que, esa ha sido la razón de su creación y existencia”. Sala Constitucional. Clase de Asunto: Recurso de amparo En lo tocante al abastecimiento de agua potable, la jurisprudencia de la Sala Constitucional también ha definido que se trata de un servicio público esencial y que por lo mismo cede ante el ejercicio de otros derechos fundamentales (6362-96 del 20 de noviembre de 1996) y que incluso los principios del servicio público se acentúan «[…] en tratándose de servicios públicos esenciales, tales como el acceso al agua potable por estar involucrado además el derecho a la salud» (Sentencia nº 13330 de Sala Constitucional de la Corte Suprema de Justicia, de 29 de Agosto de 2008)".
Fueron relacionados artículos de diversos cuerpos normativos en el apartado de la demanda identificado como fundamentos de derechos, sin esbozar argumentos que especifique en criterio de la parte demandante, como en cada caso habrían de resultar de aplicación directa al caso concreto.-
III.Sobre los alegatos de defensa formulados por la presentación de la Municipalidad demandada. Por su parte, la representación de la Municipalidad demandada indicó en oposición a la demanda, que es cierto que la parte actor es propietaria del inmueble de interés, no obstante lo cual, la captación y concesión de la naciente La Amapola es Municipal. Que a pesar de que en el oficio UPC-CAH-01507-01 el Ministerio de Salud realizó recomendaciones, estas lo fueron hace 18 años atrás, no correspondiendo con la situación actual del acueducto, mientras que por otro lado, para que el AyA le quite la administración a la Municipalidad del acueducto, existe normativa y un procedimiento que debe ser observado. Que otras de las situaciones narradas por la parte actora datan de hace 10, 7 u 8 años atrás, sin que correspondan a la realidad actual. Que el presupuesto del Acueducto Municipal ha sido bastante limitado durante el transcurso de todos esos años, lo que se ha debido a que no se cuenta con lo que fue identificado como una "micromedición", proyecto que se encuentra en la actualidad a puertas de iniciarse, lo que ha ocasionado que la tarifa conforme el consumo, haya resultado deficitaria para el mantenimiento, operación, crecimiento e inversión del acueducto.
Que respecto del estudio realizado por la Asociación o a pedido de ésta, se financió con fondos cuyo origen se desconoce, y por personas ajenas al Municipio, lo que se encuentra prohibido conforme el Reglamento para la Operación y Administración del Acueducto de la Municipalidad de Santa Bárbara, artículo 45, de modo que, dicho informe deviene en ilegal y por ende es prueba espuria, por haberse realizado en ausencia de autorización municipal y sin su acompañamiento, "... poniendo en riesgo de forme negligente la salubridad del agua, el estado de la infraestructura municipal, transgrediendo propiedad pública sin autorización, ...". Que en la actualidad el acueducto se encuentra intervenido por el AyA, el que da seguimiento a los avances del Municipio en este sentido para el cumplimiento del abastecimiento del servicio de agua. Que la tubería a la que hace referencia la actora se encuentra conectada y en funcionamiento.
Que en efecto, en razón de la orden sanitaria N° 242-2017, el Municipio se enteró de deficiencias presentes en 24 sistemas de acueducto, de los 30 que posee, no obstante lo cual, la municipalidad no se ha mantenido inactiva frente a estas circunstancias debido a que mediante oficio OAMSB-180-17, se le comunicó al Área de Salud de Santa Bárbara, sobre las primeras acciones realizadas de conformidad con lo establecido en dicha orden sanitaria, indicándose que se ha procedido a solicitar el uso de suelo para el trámite del permiso sanitario del acueducto, así como que, se ha iniciado con los trabajos para la compra y colocación de equipos de cloración en los tanques de almacenamiento del Cantón. Que esto se habría realizado el 11 de enero del 2017, informándose además que la Universidad Nacional se habría de encargar del monitoreo de la cloración, tanto como de la identificación de las nacientes y tanques a intervenir en una primera etapa.
Que finalmente, se informó sobre una tabla de los sistemas que cumplen con la medición del cloro residual según el Decreto Ejecutivo N° 38924-S. Que en efecto, la Sala Constitucional condenó al municipio por el incumplimiento de la orden sanitaria N° 242-2017, pero, que la actora omite indicar que dicha orden establece una cantidad de puntos a cumplir, entre los que se encuentran el solicitar uso de suelo y permiso sanitario, presentar un cronograma de cumplimiento y presentar un diagnóstico de la red de conducción, para lo que le fueron otorgados a la Municipalidad plazos de 1 mes, 3 meses y 6 meses, para solventar problemáticas derivadas de más de 50 años de abandono del acueducto Municipal. Que: " Efectivamente el municipio ha tenido problemas para el cumplimiento de la orden 242-2017, sin embargo, el Ministerio de Salud ha pretendido que la Administración Municipal cumpla con todo lo solicitado, sin tomar en cuenta la proporcionalidad y razonabilidad del caso, en cuenta nadie está obligado a lo imposible, el Municipio empezó a intervenir y expandir el Acueducto Municipal, siendo que el presupuesto anual del acueducto ronda los 55 millones anuales, es a todas luces insuficiente, por lo cual, el Municipio ha tenido que invertir fondos de otras cuentas, para poder cumplir con lo solicitado por el Ministerio de Salud.
Cabe señalar que el acueducto municipal actualmente no cuenta con micromedición, en el tanto que dicha licitación pública, que se está realizando mediante un préstamo del Instituto de Asesoría y Fomento Municipal, el cual duró en refrendarse dos años en la Contraloría General de la República, y fue hasta el mes de julio del año en curso, cuando el ente contralor otorgó el refrendo; por ese motivo, el municipio cuenta con una tasa de cobro fija, la cual ronda por los cuatro mil colones mensuales, la cual es deficitaria para la administración, mantenimiento e inversión del acueducto Municipal, lo que provoca detrimento en el servicio, y genera que los mismos abonados del servicio, al no tener cobro por consumo, use (sic) el servicio de agua de manera indiscriminada, debido a que el cobro de la tasa será siempre el mismo". Que en relación al hecho 26 de a demanda: "... a pesar que parte de lo aducido por la parte actora es cierto, como se indicó en varios de los hechos, no es la actual situación del acueducto municipal, puesto que en la fecha del 27 de mayo del 2019, funcionarios municipales, el alcalde (...) y miembros del Consejo Municipal se reunieron con personeros del AyA y la Presidenta Ejecutiva (...) con el fin de ver el cumplimiento del 1er y 1ndo avance del informe técnico acueducto municipal de Santa Bárbara (PRE-2018-01135 Y PRE-2018-01228) que se derivan con respecto a la orden sanitaria 236-2018 del Ministerio de Salud, en dicha reunión resulta insatisfactoria para el Instituto, y nos manifiestan que debido a dicha situación, se realizará la gestión para retomar el acueducto municipal; sin embargo, este fue causado por la poca recopilación de información de las acciones realizadas por el personal del acueducto municipal, debido al alto flujo de trabajo que existe, no se realizó un buen canal de transmisión de información entre la corporación municipal y el AyA.
(...). Que debido a lo anterior, el municipio decidió armar una comisión de asistencia al acueducto municipal, mediante resolución administrativa 127-2019 de la Alcaldía Municipal; así el 30 de mayo del 2019, mediante oficio PRE-UTSAPS-2019-00073, la Sra. Zaida Ulate Gutiérrez, de la Unidad técnica de Servicios de Abastecimiento de Agua Potable y Saneamiento del AyA señala que personeros del Instituto se trasladarían al municipio, el día 04 de junio del 2019, para solicitar toda la documentación necesaria para comprobar el nivel de cumplimiento de los informes supra citados, a lo cual el Alcalde Municipal mediante oficio OAMSB-233-19 les indica que dichos funcionarios serían recibidos por la comisión para la atención de dicho asunto. (...). Que dicha comisión (...) se avocó en grandes esfuerzos para establecer un informe que fue entregado al AyA, la Sala Constitucional y la Asamblea Legislativa, con el fin de demostrar todo lo efectuado por el Municipio para mejorar la calidad del servicio y el cumplimiento de las órdenes sanitarias, así mismo se establece todo un plan de acciones, inversiones y contrataciones a realizar para dar el cumplimiento a los informes del AyA y las órdenes sanitarias del Ministerio de Salud.
(...). el Instituto (...) a partir de la reunión del día 04 de junio del 2019 y se (sic) llevan los datos propiciados por el Municipio, entregan el 4 de julio del 2019, mediante oficio PRE-2019-00825, realiza una serie de pasos que deberá realizar el acueducto municipal para darle cumplimiento a la orden sanitaria 236-2018, siendo así que el Instituto verificó que el gobierno local no ha sido pasivo en cuanto a las mejoras que se deben realizar en la infraestructura del acueducto. (...). Entre las diferentes acciones que está realizando la corporación municipal, tenemos la modificación presupuestaria 14-2019, realizada mediante acuerdo número 3429-2019 mediante sesión ordinaria 170-2019 del 05 de agosto del 2019 del Consejo Municipal, la cual da contenido económico para ejecutar los trabajos denominados "mantenimiento y obras complementarias (obra pública) en los tanques y nacientes del Cantón de Santa Bárbara" e " implementación de tanques de almacenamiento de agua para consumo humano".
Además, para reforzar la cuenta de servicios de ingeniería para la contratación del control operativo también por AyA", siendo así, que la municipalidad ha mostrado el interés y la diligencia de realizar las mejoras pertinentes para el servicio de agua potable, sin embargo, este es un proceso integral y no sectorizado, en cuanto al atraso en infraestructura es de larga data, cuestión con la que va a tener que lidiar cualquier otro operador que entre a regir en la zona (...). Que aprobada la modificación presupuestaria supra citada, el Municipio ha realizado las decisiones iniciales de los proyectos "x" y "x", las cuales son parte de todo el plan de mejora del acueducto, con el fin de cumplir con los requerimientos del Ministerio de Salud y el Instituto (...). Que a partir del mes de "x" la Contraloría General de la República refrendó el contrato de la Contratación de Hidrómetros para al micromedición del servicio de agua potable en el Cantón de Santa Bárbara, con el cual se pretenden lograr dos objetivos, el primero es mayor recaudación de fondos con el fin de invertir y expandir los servicios del acueducto municipal, y el otro es lograr una concientización en el consumo del agua y el mejor racionamiento de dicho líquido".
Asegura la representación de esta parte accionada que la parte actora pretende con su demanda apropiarse de competencias que no le corresponden conforme la Ley, lo que le imposibilita para accionar como lo hace. Que lo que se pretende, sea concedido en sentencia -cual así lo entendemos- viola el principio de legalidad, sobre la base de esta misma razón relacionada con competencias legales. Se formuló igual reproche que el realizado frente a los informes técnicos contratados por la parte actora, respecto de los realizados por el AyA a solicitud de ésta. Para terminar, se indicó lo siguiente: "En relación al acueducto municipal, este a través de las administraciones pasadas han descuidado los sistemas de acueductos, sin embargo, cabe resaltar, que Santa Bárbara tiene una tarifa única, ya que no se cuenta con micromedición, así la tafira aprobada y publicada (...) se tiene que el monto mensual para servicio residencial es de ¢4.700, dicha tarifa ha sido deficitaria, siendo que en el informe realizado por el Municipio, existe una proyección presupuestaria, siendo que para el año 2020 se proyectan 10.080 servicios de agua, y realizando el cálculo con las actuales tarifas, el presupuesto anual del acueducto sería alrededor ¢658.864.800,00 un monto insuficiente para atender el mantenimiento, inversión y expansión del acueducto municipal, por esta razón, la municipalidad mediante un préstamo con el IFAM con el fin de aumentar la recaudación con el cobro por consumo, así como también una mejor racionalización del agua, así el 21 de junio del 2019, mediante oficio DCA-2236, la contraloría General de la República, refrenda el contrato 05-2019 que corresponde a la compra e instalación de conjuntos de medición para el acueducto de Santa Bárbara, licitación pública 2017-000001-CL.
Agregado a lo anterior, mediante informe AyA se estableció todo un plan de trabajo, inversiones y contrataciones administrativas a seguir, con el fin de dar cumplimiento a las órdenes sanitarias del Ministerio de Salud y los informes del AyA, para esto se han realizado las modificaciones presupuestarias para dotar de contenido económico, así tenemos el acuerdo 3429-2019, tomado en la sesión ordinaria 170-2019 del Consejo municipal de Santa Bárbara, donde se está asignando recursos al acueducto municipal con el fin de poder empezar con las contrataciones calendarizadas para el cumplimiento de la calidad del agua para consumo humano. Así mismo, existen modificaciones presupuestarias para atender las necesidades del acueducto, entre ellas tenemos la 11-2019, para los servicios de ingeniería, realizada en acuerdo 3215-2019 de la sesión 161-2019, la modificación 10-2019, para repartición de agua mediante camiones cisternas, mediante acuerdo 3200-2019, en sesión ordinaria 160-2019, la 09-2019, para la repartición de agua mediante camiones cisternas, acuerdo 3169-2019 de la sesión ordinaria 159-2019 (estas dos últimas modificaciones son para afrontar el impacto del fenómeno ENOS que causa bajas en los niveles de las nacientes) modificación 08-2019 para la (sic) suplencias y cubrir el personal incapacitado, mediante acuerdo 3169-2019 de sesión ordinaria 158-2019, todas del Consejo Municipal de Santa Bárbara, así las cosas, la Administración siempre ha tenido que apoyar presupuestariamente al acueducto, en cuanto los recursos captados por la tarifa son insuficientes, por ello la necesidad de arrancar con la micromedición y captar los fondos necesarios para le expansión del servicio.
Ante este panorama, es cierto que el acueducto municipal sufrió producto de abandono realizado por las administraciones pasadas, sin embargo, desde el año 2016, se han realizado una serie de acciones (que se reflejan en el informe municipal al AyA y el Ministerio de Salud) a raíz de las primeras gestiones del Ministerio de Salud en relación a la potabilidad del agua, desde enero del año 2017, la Municipalidad suscribió con la Universidad Nacional, un convenio para el monitoreo semestral de la calidad del agua, con el fin de iniciar los trabajos de compra y colocación de equipos de cloración, así como se han realizado mejoras, limpiezas, impermeabilizaciones, entre otras labores a los tanques de las captaciones de las nacientes, en los diferentes sistemas de acueducto; está llevando a cabo proyectos para aumentar la captación de recursos económicos y mejorar la racionalización del recurso hídrico, así realizando un plan integral que incluye todos los sistemas del Cantón y no una visión fragmentada como la que expone el actor, valiéndose incluso de prueba, recolectando por medios no idóneos, para exponer una situación que no corresponde al estado actual del acueducto municipal.
Siendo que el acueducto se encuentra en proceso de realizar todas las mejoras correspondientes, este ente municipal seguirá remitiendo la documentación que se vaya generando a raíz de dicho proceso, con el fin de que el Tribunal tenga el pleno conocimiento del avance del Municipio en el tema de inversión del acueducto". Fueron interpuestas las excepciones de falta de legitimación activa, sobre la base de las competencias legales que sólo corresponden al Instituto codemandado y el procedimiento previsto para el caso en que dicha entidad decida o no, asumir la administración de un acueducto conforme el Reglamento de Aprobación y Recepción de Sistemas de Saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados, numerales 12 al 18 contenido dentro del capítulo III, sobre los requisitos y procedimientos para ello, en relación con el artículo 19 de este mismo cuerpo reglamentario.
Esto se relacionó con la Ley Sobre el Desarrollo de la Comunidad (DINADECO), Ley N° 3859, artículos 17, inciso b) y 24. Sobre las funciones de estas asociaciones, para afirmar que la parte actora no tiene competencia alguna relacionada con el control y/o fiscalización de este servicio. Además, se alegó como excepción la de falta de derecho.-
IV.Sobre los alegatos de defensa formulados por la presentación del AyA. Por su parte, la representación de esta parte accionada se expresó también en oposición a la demanda, en el sentido de que la parte actora pretende desconocer toda la actividad realizada por el Instituto en todos los sistemas administrados por la Municipalidad aquí codemandada, entre los que se encuentra el acueducto de interés. Que la parte actora refiere a prueba constituida por informes que datan de 19 años atrás. Que no le consta una deficiente administración o mantenimiento por parte de la Municipalidad sobre este acueducto. Que la parte actora refiere a muestras que corresponden a controles de verificación bacteriológica y sanitaria realizados en el 2001 y que por tanto, se encuentran desactualizados. Que el hecho de que el Instituto hubiere atendido alguna o algunas gestiones no implica su deber de entrar en administración del acueducto, siendo lo que realizó en uso de sus competencias, recomendar en el plano técnico, acciones que debían de ser realizadas por el operador de este bien, habiéndose hecho la intervención del acueducto en el momento oportuno ordenado a raíz de una sentencia, emitiendo recomendaciones para la mejora del servicio y las condiciones del acueducto.
Que: "De los hechos descritos no presenta prueba técnica fehaciente y actual que demuestre que las afirmaciones realizadas tienen algún asidero con la realidad; y no se puede tener legitimación sobre una mera especulación o afirmación arbitraria, porque nuestro sistema jurídico está fundado en la buena fe, en la legalidad, en la razonabilidad de las conductas y no en la arbitrariedad. El AyA ha venido realizando una serie de actos de intervención del acueducto de Santa Bárbara de Heredia, a raíz de la orden sanitaria N° 236-2018 emitida por el Ministerio de Salud. A través de esta intervención se ha generado una serie de información y documentación sobre la administración de dicho acueducto, que permite conocer y diagnosticar el estado actual del mismo. En virtud de la información disponible y con base en los resultados del análisis de calidad del agua que se detallan en el oficio PRE-LNA-01168 (...) que corresponde a un monitoreo llevado a cabo entre el 18 y el 20 de junio del 2019 en la red de distribución en cada uno de los 21 sistemas que conforman el acueducto de Santa Bárbara, en donde se determinó lo siguiente: ...
De los 21 sistemas monitoreados, en dos muestras de dos de ellos se detectaron indicadores de contaminación fecal: Setillal Norte de Puraba de Santa Bárbara (sistema Quirós) y Jesús de Santa Bárbara (Cuesta Colorada) representando un 3% (2/62) de los puntos muestreados en los acueductos administrados por la Municipalidad de Santa Bárbara que ofrecen agua de calidad no potable. Estos acueductos abastecen aproximadamente a 3428 personas (según datos del 2014) representando un 13% de la población cubierta por los sistemas administrados por la Municipalidad". "Además, se realizaron 62 determinaciones de cloro residual libre (dado que todos los sistemas se reportan como clorados) de los cuales, 47 de las mismas se encontraban por debajo del valor mínimo indicado por el Reglamento, representando un 76% (47/62) de los acueductos administrados por la Municipalidad de Santa Bárbara. Por otro lado, dos determinaciones estuvieron por encima del valor superior permisible de cloro residual libre, representando un 3% (2/62) de las determinaciones (sistema Ruiseñor en Urbanización Ruiseñor de Jesús de Santa Bárbara y sistema Mesén en Urbanización mesén de Birrí).
Mi representada presenta un informe detallado que corresponde a un estudio del "estado actual del Acueducto Amapola" tomando puntos aleatorios y zonas conocidas por presentar problemas. Por consiguiente y de conformidad con lo que se desprende el (sic) informe técnico UEN-PyD-GAM-2019-00372, lo prioritario para el sistema Amapola, es la ejecución de un control operativo de la calidad del agua en las redes de distribución, de forma tal que se sigan las recomendaciones establecidas para la adecuada dosificación del cloro y el monitoreo constante de las redes. Bajo estas instrucciones, el operador podrá asegurar el cumplimiento de los niveles de cloro residual en las redes, según los rangos aceptables estipulados en el Reglamento para la Calidad del Agua. Finalmente, sobre el documento de denuncia presentado por la Asociación de Desarrollo Integral del Roble de Santa Bárbara de Heredia, se indica lo siguiente: Informe diagnóstico que presentan contiene información levantada en el 2013.
Por este motivo, algunas de las condiciones expuestas en este informe no concuerdan con la información levantada durante el 2018 por AyA. Se aduce que existe una quebrada y que la Municipalidad capta aguas superficiales de dicha quebrada para incorporarla en la producción del sistema. En el informe de AyA se advierte sobre la cercanía de algunas nacientes de este sistema, a una quebrada, la cual en época lluviosa puede salirse de su cauce e invadir el área donde se encuentra la naciente, por lo que se debe (sic) monitorear estas situaciones y tomar las medidas que correspondan para proteger la naciente y evitar que se filtren aguas superficiales dentro de la caja de protección. Sin embargo, en ningún momento se indica que al sistema se está inyectando agua superficial captada de la quebrada, dado que esto no fue evidenciado en las visitas. Se aduce que el informe de AyA indica que se encontraron coliformes fecales en el sistema Amapola.
Aquí se debe aclarar que los coliformes aparecen en muestras tomadas en las nacientes, sin embargo, se indica que, en las redes de distribución, si bien los niveles de cloro residual no cumplen estrictamente con los rangos estipulados en el Reglamento, los resultados de laboratorio también evidencian que no se encontraron coliformes en la red, lo cual implica que el agua que están consumiendo los usuarios está libre de coliformes, gracias al proceso de desinfección que se realiza. Incluso, con respecto al sistema de desinfección del sistema Amapola, en el Primer informe de Avance se recomienda un estricto control operativo para garantizar los niveles adecuados de cloro residual en la red, dado que el equipo de desinfección es el apropiado y funciona adecuadamente. En el más reciente informe de seguimiento al Plan de Acción, se evidencia que la Municipalidad sustituyó el sistema de desinfección para un mejor control de la dosificación del cloro.
Además, se instaló una válvula reguladora de globo antes de flujómetro. Se le consultó al encargado de realizar la desinfección en el acueducto sobre el control de la disificación, para lo cual él indica que lleva una bitácora donde anota todos los registros en el campo. Indicó, además, que realiza un recorrido los lunes y martes en todo el acueducto para colocar las pastillas de cloro en todos los equipos, y que el resto de los días realiza mediciones de cloro residual en todo el acueducto. Si se presenta alguna situación en la que el cloro residual no esté entre los parámetros permitidos, se debe postergar las mediciones para resolver la situación. Lo anterior, en cumplimiento del cronograma definido en el 2do Informe de Avance para las acciones de mejora que debe ejecutar la Municipalidad en los próximos 5 años. En el punto vigésimo cuarto, se referencia una supuesta cita textual extraída del primer informe de avance, según se muestra a continuación: "En cuanto a los tanques de reunión de las nacientes y tanque de almacenamiento Amapola, carecen de cloración de aguas, mantenimiento, limpieza y acceso a los tanques, no tienen rotulación de prevención, no seguridad perimetral".
Decir que el sistema carece de cloración de aguas no coincide con ningún pasaje del citado informe y no concuerda con la veracidad de la información levantada por el AyA tanto en el año 2018 como en las inspecciones de seguimiento del 2019, dado que el sistema Amapola sí cuenta con sistemas de desinfección y prueba de ello son los resultados de laboratorio, donde se registra la concentración de cloro correspondiente a los puntos muestreados en la red. Se aclara que AyA como ente especializado en la materia, o bien la Municipalidad de Santa Bárbara, respecto al área en que opera el acueducto local, son los que de acuerdo a los estudios y valoraciones técnicas, que definen y deciden, cuál es la opción idónea de tratamiento de las aguas, no es una decisión de un particular, en razón de que el particular carece de conocimiento, de la experticia, de la información y el AyA ha venido realizando una intervención en los sistemas de acueductos de la Municipalidad de Santa Bárbara de Heredia, y en dichas gestiones de intervención se redujo el razago que en ese campo existía en la zona.
Hay enormes logros institucionales en la mejora al sistema del acueducto local, considerando que se trata de un sistema complejo, que consta de 21 sistemas. El AyA ha trabajado en primera línea en mejoras al acueducto Municipal, para brindar un servicio de calidad, eficiencia y continuidad en el abastecimiento del agua a todas las poblaciones de Santa Bárbara de Heredia. Es importante destacar, que en muchos casos la población no hace un uso racional del recurso, y en esta materia tenemos responsabilidad tanto los operadores como los usuarios, en este sentido a nivel institucional existen una serie de programas con el programa bandera azul, defensores del agua, capacitación en escuelas, preservación y generar conciencia sobre la necesidad de hacer uso racional, responsable y solidario del recurso hídrico, que aplican para un conocimiento y proyección a nivel nacional, no solo para usuarios del AyA, de manera, que con eso se busca generar una labor social y mayor conciencia sobre la necesidad de que cada ciudadano valore su responsabilidad personal en un tema que nos afecta a todos y cuya solución en muchos casos, está en manos de los usuarios, que en gran medida desperdician el recurso y exigen calidad y cantidad para lavar vehículos, regar el césped, etc..
En la actualidad la población debe tener claro que por hechos de la naturaleza, se ha dado una fuerte merma en las fuentes de agua subterránea y superficiales, que ha afectado a todo el país, no solo a parte de la población, lo que se ha incrementado por el crecimiento desmedido y poco planificado de desarrollos urbanísticos, en muchos casos existen fuertes intereses económicos que generan gran presión sobre la autorización para avalar construcciones, en especial, de proyectos de interés social, que son los que generan mayor presión sobre la demanda de agua, de manera que eventualmente, este tipo de situaciones se podrían solventar, planificar, programar solo a través del Gobierno Local, mediante un instrumento esencial, en estos casos, como lo es el ordenamiento territorial, recordemos que la Ley de Planificación Nacional, señala que no se podrán autorizar desarrollos si no se cuenta con los servicios básicos o si éstos son prematuros, de manera tal que ese es un mecanismo fundamental con el que cuentan los Gobiernos Locales, no así otras instituciones que deben respetar la autonomía municipal como lo es el AyA.
Pese a lo expresado, se reitera que los hechos planteados por el recurrente, en principio no le deberían constar a mi representada, en razón de que el Instituto no opera ni administra el sistema de acueducto y alcantarillado en la zona de Santa Bárbara de Heredia, se trata de un sistema administrado por el Gobierno Local, sin embargo, esos sistemas de acueducto han presentado serios problemas desde un punto de vista integral, que el AyA conoce de diversas gestiones que ha realizado el Gobierno Local, con la finalidad de brindar y mejorar el servicio de acueducto que administra. Todas las mejoras y recomendaciones necesarias al sistema de acueducto que administra la Municipalidad de Santa Bárbara, emanadas por parte del AyA se encuentran indicadas en el oficio UEN-PyD-GAM2019-00372, de fecha 18 de julio de año 2019, suscrito por el Ing. jorge Luis Espinoza Bolaños en la UEN Producción y Distrubución GAM y sus anexos, por lo que, lo que debe hacer la Municipalidad realmente es avocarse a gestionar las mejoras que se le han señalado mediante diversos estudios y reuniones.
Como ya se ha indicado en diversas ocasiones, en los estudios realizados por el AyA, se dan una serie de recomendaciones, que son de resorte del operados ejecutarlas, lo que les permitirá en alguna medida optimizar el acueducto, lo cual, debe ser resuelto por el administrador del sistema, que en este caso es la Municipalidad, que por su parte, debe contar con una tarifa que le permita atender no solo los costos operativos y administrativos, sino un rédito para la inversión, como se ordena en la Ley General de Agua Potable. Se recalca y reitera que AyA no cuenta con los mecanismos coercitivos para obligar al Gobierno Local a realizar las mejoras por tanto el tema es de entera responsabilidad de la Municipalidad por más seguimiento que se brinde por parte del AyA respecto a ese tema. Se destaca que dada la competencia que conlleva la Municipalidad en la administración del acueducto y que como instituciones públicas nos encontramos regidos por el Principio de Legalidad y por tanto, también la legalidad presupuestaria, debemos ajustarnos a disposiciones expresadas de ley que inhiben de realizar intervenciones en sistemas no administrados por AyA, tal y como se dispone en la Ley Constitutiva de AyA, Ley Financiera de la República de Presupuestos Públicos y en especial, lo ordenado en el artículo 10 de la Ley General de Agua Potable, que establece clara responsabilidad en este aspecto del operador del acueducto, sea de AyA o sea municipal.
En ningún momento este Instituto le ha dado la razón a la Asociación de Desarrollo Integral del Roble de Santa Bárbara de Heredia, al contrario, el AyA se encuentra realizando las valoraciones respectivas que permitan determinar si se asume o no el acueducto. A raíz de las recomendaciones dadas al ente operador, es que se podrá valorar asumir la integridad del acueducto, pero muy puntualmente se puede afirmar que el sistema La Amapola no presenta hoy día un riesgo para la salud pública, esto a partir de las valoraciones realizadas y las pruebas del Laboratorio Nacional de Aguas. El AyA se encuentra a la espera de los resultados de las recomendaciones giradas al operador, por lo cual es muy prematuro afirmar que se intervenga la administración de un acueducto tan complejo y sobre el cual se ha venido trabajando. Así mismo, si el Instituto decidiera asumirlo queda a su discreción de acuerdo con los informes técnicos si la mejor opción sea delegarlo o no en una Asada, para lo cual se necesitaría de un acuerdo de Junta Directiva". Fue interpuesta a título de excepción de fondo, exclusivamente la de falta de derecho.-
V.Hechos probados. De relevancia para la resolución del presente proceso, se tienen como hechos probados:

VI.Hechos no probados. De relevancia para la resolución del presente proceso, se tienen como hechos no probados: 1) Que a partir de la operación del sistema administrado por la Municipalidad demandada denominado "La Amapola" componente integrante del acueducto municipal de interés desde el punto de vista técnico y/o científico, el servicio público de suministro de agua potable que se brinda se pueda calificar de ineficiente, o en su caso, también desde el punto de vista técnico y/o científico, sanitario y financiero en el marco de la más adecuada prestación del servicio de suministro de agua potable, se haya determinado la conveniencia de que éste exclusivo sistema deba ser administrado por el AyA, tanto como que, medien aspectos presupuestarios que no condicionen una decisión en esta dirección. (La ausencia de elementos de convicción al respecto); 2) Que parámetros susceptibles de comprobación en el plano técnico y/o científico habrían de concurrir o resultan necesarios para determinar que un servicio de suministro de agua potable es ineficiente. (La ausencia de elementos de convicción al respecto).-
VII.Sobre el fondo del asunto. Es el criterio de esta Cámara, que en el presente caso se impone declarar la demanda sin lugar en todos sus extremos, en función de las siguientes consideraciones:

Los resultados sobre la calidad del agua en el sentido de que es potable con anterioridad al momento de la presentación de la demanda que se conoce en los términos de la presente sentencia, además de concluyentes, se encuentran reforzados según el criterio del propio Ministerio de Salud en el marco del ejercicio de sus funciones y la especialidad de la materia de la que es competente. Esta situación se ha mantenido invariable, pues incluso al menos para el día 30 de octubre del 2019 la calidad de las pastillas que se utilizan para la desinfección de los sistemas del acueducto de interés cumplen con la normativa internacional vigente conforme memorando de esa data dirigido por "Uen Producción y Distribución Gam, a la Presidencia Ejecutiva, ambos del AyA (la imagen 705 del expediente judicial) y en el mes de noviembre del año 2019 el AyA levantó un informe de calidad del agua de los acueductos operados por la Municipalidad aquí demandada, habiéndose tomado 3 muestras de agua de la red de distribución en cada uno de los acueductos administrados por el Municipio a las que se les realizaron ensayos microbiológicos de indicadores de contaminación fecal de detección de coliformes termotolerantes (coliformes fecales) y Escherichia coli, así como sobre cloro residual, habiendo sido además registrado en lo que interesa, el siguiente resultado: fecha: 05/11/2019; sector, El Roble Santo Domingo de Santa Bárbara; muestras: Liceo El Robe, Delegación Policial, Ferretería Acosta; residual de cloro libre (mg/L): 0.07 para el caso de la muestra de ensayo tomada en Liceo El Robe y Delegación Policial, y 0.19, del sitio identificado como la Ferretería Acosta; ausencia de coliformes fecales y de E coli, para un 96% de cumplimiento con la calidad microbiológica del agua, no obstante, sí se detectó un residual de cloro por debajo del rango establecido como valor mínimo.

Para ir concluyendo en relación a estos hechos que consideramos relevantes, al menos para el 15 de abril del 2021 el AyA continúa sobre la base de la intervención o en su caso, seguimiento y acompañamiento que realiza al acueducto municipal y ejecución de un plan remedial y se le da seguimiento en particular, a temas asociados a la calidad del agua, recursos financieros y contratación de bienes y servicios, trabajos de mejora en infraestructura y mantenimiento de componentes, así como a lo que se identificó como un plan de contingencia y protocolo de comunicación, en relación a los que, se afirma que la Municipalidad aquí demandada ha desarrolado esfuerzos efectivamente dirigidos a la mejora integral del acueducto. (Las imágenes que van de la 971 a la 1002 del expediente judicial en que obra el texto del documento emitido por el AyA denominado "Informe del proceso de intervención según acuerdo de Junta Directiva N° 2020-185 (orden sanitaria N° 236-2018) y de respuesta a lo solicitado por la Sala Constitucional de la Corte Suprema de Justicia, en respuesta al recurso de amparo expediente 20-011545-0007-CO").
Finalmente, conforme el oficio identificado con el N° ACMSB-021-2022 de fecha 17 de febrero del 2022 emitido por el Administrador del acueducto administrado por la Municipalidad demandada, se hizo a titulo de conclusión la siguiente afirmación en lo conducente: "El hecho de que una naciente se encuentre geográficamente en un punto, no quiere decir que la misma abastecerá solamente a ese sector. Como es el caso de la naciente Amapola, que no solamente abastece El Roble, sino que abastece las comunidades de: (...) Calle Amapola, Cuesta Los Patos, San Bosco de Purubá, Zetillal de Santa Bárbara, Calle Potrerillos en Santa Bárbara. (...) Se debe tomar en cuenta que la Municipalidad de Santa Bárbara mejoró gran parte del sistema Amapola y realizó la instalación de hidrómetros gestionando un crédito importante. A la fecha, el tema de intervención sanitaria del AyA y órdenes sanitarias del Ministerio de Salud, son temas que han sido superados con un esfuerzo importante y que ha plasmado en todos los informes y pronunciamientos del AyA y Ministerio de Salud".
(Las imágenes 1110 a la 1124, de la que resulta de relevancia la información -como se verá- específicamente comprendida en la imagen 1123). Dicho todo lo anterior, si de la pretensión dirigida a que se ordene al AyA asumir o entrar a administrar y operar el acueducto de interés, solo en uno de sus 21 sistemas, a saber, el denominado "Amapola" en lo que éste integralmente comprende, sin que la parte accionante haya argumentado algo al respecto, se tiene que su teoría del caso no se erige sobre el presupuesto de la adopción por parte del AyA de una conducta omisiva en desajuste con el ordenamiento jurídico. Tampoco afirmó quien demanda que habiendo mediado una solicitud formulada en sede administrativa al AyA para que asumiese la administración y operación de este sistema, haya generado el dictado de un acto administrativo que en rechazo de tal solicitud, sea objeto de impugnación en la presente causa.
En su lugar, lo que se pide se dirige simplemente a que se dicte tal orden por esta Autoridad Judicial, específicamente a partir de la que propone quien demanda, es la comprobación de que el servicio prestado a la comunidad de El Roble de Santa Bárbara, es contrario a los principios que lo informan, de continuidad, eficiencia, adaptación e igualdad en el trato de los destinatarios, usuarios o beneficiarios. Este Tribunal estima estéril o innecesario entrar a analizar y en consecuencia, hacer pronunciamiento en torno a si se demostró o no que este servicio es prestado de modo discontinuo, tanto como si lo es en igualdad de trato frente a los usuarios, para lo que bastará con indicar que no fueron esbozados hechos en la demanda ni estructuras argumentativas en este sentido, por lo que, ambos temas no habrían sido objeto del debate. Por otro lado, ya indicamos que el caso se ha de resolver atendiendo a la aplicación directa del artículo 2, inciso g) de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, de donde lo que habría de demostrarse para concluir que lo así prendido resulta procedente, lo es que el servicio prestado es ineficiente, así como y superado ese punto, que media conveniencia para que sea el AyA quien asuma su administración y operación, tanto como que, tal conveniencia no se encuentre condicionada a aspectos presupuestarios.
De ahí que el tema medular tiene que ver con la eficiencia del servicio exclusivamente, que bien podría asociarse al principio de adaptación. Consideramos desde este punto de vista que la determinación de qué presupuestos en lo técnico y o científico habrían de concurrir para determinar que un servicio de la especie es ineficiente, resultaba necesario, no siendo resorte de los Jueces dado su ámbito de conocimiento, formular conclusiones sobre la base de deducciones al respecto. Según el diccionario de la Lengua Española, eficiencia es "1. f. Capacidad de disponer de alguien o de algo para conseguir un efecto determinado. / 2. f. Capacidad de lograr los resultados deseados con el mínimo posible de recursos". (El resaltado no es del original). La amplitud del término es incuestionable. Así es que estimamos, que una cosa lo es afirmar que un sistema acueducto sea operado con falencias, incluso si son muchas de ellas, y otra encontrarse en posición de afirmar desde el punto de vista técnico o científico, que ellas sí habrán de conducir a concluir que el servicio es ineficiente, al grado de provocar la pérdida por parte del Municipio, de su administración y operación.
Prueba pericial en esta dirección, sea, que concrete en función de qué razones y presupuestos concretamente y con un mínimo de rigor en cuanto a especificidad es que se puede calificar de ineficiente un servicio de este tipo, era totalmente necesaria, mientras que la traída al proceso no es concluyente al respecto. Aquí es que resulta relevante la posición asumida durante la tramitación del proceso en juicio por parte del AyA, ya que se opone a esta pretensión. Ninguna de las partes ha hecho referencia a normativa reglamentaria que desarrolle los alcances del artículo 2, inciso g) mencionado, de existir, por lo que este Tribunal dedicó tiempo para lograr ubicar alguna, sin éxito y por ello es que frente a la ausencia de prueba al respecto hemos determinado como un hecho no probado, la existencia de parámetros susceptibles de comprobación en el plano técnico y/o científico que habrían de concurrir o resultan necesaria para determinar que un servicio de suministro de agua potable es ineficiente.
En esta línea de pensamiento, aunque habría sido deseable que existiese algún acto administrativo adoptado por el AyA, reglamentación promulgada por éste, o en su caso, una argumentación que explique o desarrolle lo anterior, o en su caso, en razón de qué circunstancias es que siquiera se ha planteado a lo interno del AyA asumir este sistema de acueducto, lo cierto es que vistos sus argumentos de defensa y la prueba integralmente entendida, con total independencia de las razones que condujeron a que "interviniese" el acueducto de interés como un todo, lo cierto es que en lugar de ello, ha estimado y así ha conducido su conducta dentro de lo que entendemos, es un margen de discrecionalidad al respecto, a ejercer sus potestades como rector de este sector para direccionar en lo que le compete, la conducta de la Municipalidad demandada a la corrección de las falencias que presenta el mismo, en materia de procedimientos, infraestructura y sanidad, sin perjuicio de la concurrencia en este último ámbito del Ministerio de Salud.
La parte actora tampoco ha direccionado su teoría del caso a cuestionar el ajuste con el ordenamiento jurídico o no de esta postura administrativa adoptada por el AyA. Se insiste en que el artículo 2, inciso g) de la Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados en asocio con los restantes incisos que comprenden este numeral de Ley, confieren al AyA un importante margen de discrecionalidad al respecto, no bastando con que el servicio se preste de manera ineficiente para asumir la administración de un sistema de acueducto, cuando en su lugar, se encuentra habilitado para ponderar una decisión como esa, en aspectos de conveniencia y de presupuesto. En concreto véase que el inciso b) de este artículo 2, dispone que es competencia del AyA determinar la prioridad, conveniencia y viabilidad de los diferentes proyectos que se propongan entre otras cosas, para reformar, ampliar, modificar obras de acueductos, las que no se podrán ejecutar sin su aprobación, de modo que no decidir excluir del ámbito de acción de un municipio un sistema de acueducto, y en su lugar, optar como en este caso por procurar un acompañamiento como ente rector para promover su mejora integral, que es lo que ha venido ocurriendo en el caso concreto, no sólo encuentra respaldo en esta norma, sino que y además, es un aspecto sobre el que no se discute en el presente proceso judicial, simplemente porque no ha sido propuesto como objeto de debate por la parte accionante.
Luego y sumado a todo lo indicado a este punto, si esta última postura administrativa que en efecto ha asumido el AyA no ha sido cuestionada por la parte actora, ni ha argumentado en función de qué consideraciones es que en lugar de discrecionalidad, ha mediado arbitrariedad en función de las reglas de la ciencia y/o técnica, este Tribunal no se encuentra en situación procesal de poder hacer un análisis al respecto. Es de este modo que esta Cámara no puede afirmar que la decisión implícita -porque no es expresa- o en su caso, omisiva, formal y material del AyA de no asumir la administración y operación del sistema del acueducto identificado como Amapola es contraria a derecho, como tampoco, la decisión que sí se desprende con claridad de la prueba, de acompañar en un proceso de mejora del acueducto en sus 21 sistemas a la Municipalidad demandada, y en consecuencia del servicio que se presta de suministro de agua potable.
Ha de indicarse a la parte actora además, que este proceso que se denominó de "intervención" inició previamente a la interposición de su demanda, y ha sido programático en la definición de diversas acciones todas dirigidas a la corrección de las falencias técnicas y sanitarias que presentaba, lo que explica porqué la representación Municipal se ha empeñado en demostrar el progreso en avances de este proceso, tanto como al estado actual del acueducto en su totalidad, y del sistema Amapola en lo específico, siendo un aspecto, que si de la conveniencia se trata a propósito de lo dispuesto en el artículo 2, inciso g) de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, resulta relevante. Debe hacerse notar al respecto, que por la forma en que fue incluso evolucionando el tema de la desinfección en términos de la calidad del agua, previo a que demandase la parte actora, el tema de la presencia de coliformes fecales y/o E coli, había sido solucionado en cumplimiento de lo dispuesto en el "Reglamento de la Calidad de Agua Potable", sin perjuicio de que hacían falta ajustes sobre lo vinculado con el cloro residual sólo en parte del acueducto para garantizar la inocuidad del agua, pero en todo caso, se determinó, que es potable, incluyendo la que proviene del sistema Amapola.
Es en este sentido que en criterio de este Tribunal que no estimamos concluyente incluso el contenido y alcance de los dos informes periciales aportados por la parte actora, que en su momento fueron levantados por el Ingeniero Fernando Sánchez Redondo, que refieren a aspectos relacionados con la infraestructura del acueducto que en su opinión, en su momento le condujeron a afirmar que el sistema se encontraba colapsado, frente a la norma comprendida en el tantas veces mencionado artículo 2, inciso g) y restantes incisos de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, pues evidentemente ha mediado alguna evolución posterior en este sentido dada bajo la rectoría del AyA y el seguimiento del Ministerio de Salud, a lo que se suma, que el aspecto relacionado con la calidad del agua, ha sido superado con éxito, sin perjuicio de que en su declaración bajo la fe del juramento durante la celebración de la audiencia complementaria de juicio oral y público, precisó haber visitado el sitio de las nacientes Amapola, así como que problemas asociados a la en su criterio profesional, no solucionados aún y que fueron referidos desde el momento del levantamiento de sus informes periciales, suponen un riesgo de contaminación.
Esto impone decir que en materia de la calidad del servicio en lo que a calidad del agua refiere el servicio es eficiente, ahora sí con claridad, que no siendo un tema objeto del debate la continuidad del servicio, no se puede afirmar que ese principio no se cumpla, lo mismo que ocurre con el vinculado con la prestación en igualdad de trato frente al usuario, mientras que restaría el tema de la adaptación del servicio al cambio, que sí se podría asociar al tema de la eficiencia, aspecto que ya ha sido abordado desde el año 2019 y a la fecha, pero en todo caso, se reitera, que la determinación de si sobre la base de este último punto residual, el servicio ha de calificarse de ineficiente, ello no se demostró con prueba pericial por un lado, mientras que por otro, aún y de haberse probado ello, restaban tres temas que siquiera fueron objeto de debate, como la conveniencia y aspectos presupuestarios, tanto como el ajuste o no con el ordenamiento jurídico de la adopción de una conducta administrativa dada en el marco de la discrecionalidad de que goza el AyA como Administración Pública, de acompañar un proceso de mejora en apariencia, de lago o mediano plazo, en lugar de asumir directamente el sistema de acueducto.
En razón de todo lo anterior se impone declarar la improcedencia de la pretensión identificada como la "b", y en consecuencia, debiendo correr su misma suerte, la improcedencia de la pretensión "c" como en efecto así se falla y consecuentemente, improcedente la demanda en todos sus extremos. En relación al resto de la prueba documental que obra en físico, así como la declaración en juicio rendida por la señora María Antonieta Acuña Hernández, estimamos habiendo sido revisada la misma, que no aporta algún elemento de juicio que conduzca a fallar de un modo diverso al que este Cámara lo hace.-
VIII.Sobre las excepciones interpuestas. La representación del AyA interpuso en su defensa, exclusivamente la excepción de falta de derecho, mientras que la de la Municipalidad demandada además de esta, la de falta de legitimación activa. En torno a la excepción de falta de legitimación activa, se rechaza, bastando con indicar a la representación Municipal que la Asociación actora demanda lo haya detallado así o no, en defensa de intereses colectivos de los vecinos que asociados en ella, han estimado lesionado sus derechos o intereses legítimos a partir de la prestación de un servicio público municipal, de donde no se observa que carezcan de legitimación para demandar como lo hicieron en ese tanto, que es el que interesa. Por otro lado, en relación a la excepción de falta de derecho interpuesta por ambas partes demandadas, bastando con remitir a las partes al análisis contenido en el cuerpo de la presente sentencia, no mediando derecho en la Asociación actora para acceder integralmente a la totalidad de lo peticionado.-
IX.Sobre las costas. De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo, no obstante lo cual consideramos en aplicación de lo dispuesto en el artículo mencionado en su inciso b), que en el presente caso por la naturaleza de las cuestiones debatidas ha existido motivo bastante para litigar, por lo que se dicta el presente fallo, sin especial condenatoria en costas.-
POR TANTO
Se admite de la prueba ofrecida para mejor resolver por la representación de la Municipalidad demandada, exclusivamente la comprendida por la totalidad de ofrecida por escrito presentado a estrados judiciales el día 13 de enero del 2020, así como la comprendida a imágenes del expediente judicial que van de la 971 a la 990 y la que va de la imagen 1110 a la 1124, la restante se rechaza. Se rechaza la excepción de falta de legitimación activa interpuesta por la Municipalidad demandada. Se acoge la excepción de falta de derecho interpuesta por ambas partes demandadas y en consecuencia, por resultar improcedente la demanda en la totalidad de lo pretendido, se declara sin lugar en todos sus extremos. Se dicta el presente fallo sin especial condenatoria en costas.- Notifíquese.- Juez Ponente Felipe Córdoba Ramírez.- Jueza Judith Reyes Castillo.- Juez Elías Baltodano Gómez.- ???????????????
