THE STATE No. N° 2023005608 ADMINISTRATIVE AND CIVIL COURT OF THE TREASURY, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at eighteen hours and seven minutes on veinte de Noviembre del dos mil veintitres.- Interim relief requested by Mr. Claudio Donato López, in his capacity as special judicial attorney-in-fact (apoderado especial judicial) for Punta Sabana Developments, Ltda, legal entity identification number n° 3-102-704182, against the Municipalidad de Santa Cruz.
BACKGROUND:
At the same time, it granted the defendant entity an opportunity to be heard and notified the State and SINAC so that they could enter an appearance if they deemed it appropriate. (Image 30 of the digital case file, interim-relief record).
CONSIDERING:
The claimant states that Playa Zapotillal (known as Playa Minas) is recognized as a turtle-nesting site and that it owns a property in the vicinity of that beach. It states that, at present and due to the omission of the defendant municipal authority, nothing prevents motor vehicles from entering and traveling through the public zone of the maritime-terrestrial zone, thereby seriously harming the turtles—particularly the black turtle—as well as their eggs and nesting activity. It alleges that large numbers of people and motor vehicles are entering the beach, including persons engaged in commercial activities (all-terrain vehicle tours), which directly harm turtle-nesting areas and egg development, including through nighttime activities of the same kind. Thus, the claimant states that the entry of vehicles onto the beach and into the public zone of the maritime-terrestrial zone results in the destruction of turtle nests and eggs, harm to the turtles, their inability to build nests, and damage to their ecosystem.
In addition, the claimant states that unauthorized camping activities are taking place on the beach, causing environmental harm from waste left by persons arriving in their vehicles and by those who camp there, despite the absence of basic services. It further states that campfires lit by those persons create a high risk of forest fires, with potentially greater harm to flora and fauna, and that this also occurs because of the defendant Municipality’s tolerance. Accordingly, the claimant requests the following: “(...) We request that, as interim relief, the Municipalidad de Santa Cruz be ordered to take immediate action to prevent motor vehicles from traveling and parking in the maritime-terrestrial zone of Playa Zapotillal. For this purpose, it shall install and maintain barriers preventing vehicles from accessing and entering the public zone. It shall also ensure that the barriers prevent motor-vehicle traffic but do not impede free pedestrian access for persons wishing to enter Playa Zapotillal.
This interim relief shall remain in effect throughout the time required for the final resolution of this action.” (Image 24 of the digital case file, interim-relief record). For its part, the Municipalidad de Santa Cruz stated that it had posted signs prohibiting passage at Playa Zapotillal and that police operations would be conducted to prevent vehicles from entering the beach’s public zone. It also requested that the State, SINAC, MINAE, Dirección de Policía de Tránsito, Ministerio de Seguridad Pública, and Fuerza Pública be joined in the action (litis). Finally, it argued that it had not failed to protect the maritime-terrestrial zone.
Interim judicial protection arises from the general scope of the constitutional guarantee of prompt and effective justice (Article 41 of the Constitution (Carta Magna)) and encompasses the right to request from the court all interim measures that are necessary, suitable, and appropriate to guarantee the effectiveness of the judgment on the merits (sentencia de mérito), as well as the advance and provisional satisfaction of litigants’ substantive legal positions (situaciones jurídicas sustanciales). Interim judicial protection seeks to moderate or mitigate the effects of the ordinary duration of judicial proceedings, so that persons’ legal positions are not damaged, diminished, or impaired as a result of the duration of the proceedings themselves. Consequently, the Chiovendian principle is fully applicable when it states that: “The need to resort to judicial proceedings in order to vindicate one’s rights must not cause harm to a person who is likely to be in the right.” Correspondingly, the Judge is obligated to order or adopt such interim measures as are appropriate and necessary for those purposes.
Interim protection (tutela cautelar) may be sought when there is a risk that the substantive legal positions asserted by the applicant could actually or with potential certainty disappear or be seriously, or even irreparably, damaged or impaired. In those terms, it is clear that interim judicial protection facilitates the proper exercise of the prompt and effective judicial function and, at the same time, preserves intact both the subject matter of the proceedings—that is, the claim for relief (pretensión)—and the corresponding substantive legal position for which protection is sought, for the time necessary to ensure the proper conduct of the proceedings on the merits.
The essential and indispensable requirements for granting interim relief are: (i) likelihood of success on the merits (apariencia de buen derecho), (ii) danger in delay (peligro en la demora), and (iii) the balancing of the interests at stake (ponderación de los intereses en juego); specifically: a) Likelihood of success on the merits, or fumus boni iuris: This consists of a hypothetical assessment of probability or plausibility arising not only from the seriousness of the action, but also from the likelihood that the principal issue will be decided favorably; in this regard, that initial appearance of seriousness is considered sufficient to satisfy this requirement. Fumus boni iuris seeks to verify that the claim is not frivolous and that the action presents at least an initial and reasonable indication of seriousness. In decision No. 96-F-TC-2009, the Tribunal de Casación de lo contencioso administrativo also referred to this requirement as fumus non mali iuris, that is, the appearance that no improper right is being exercised. b) Danger in delay, or periculum in mora: This consists of the objectively ascertainable fear or danger that delay in conducting the principal proceedings will result in the loss, deterioration, or frustration of the substantive legal position asserted, which in such cases would render the judgment on the merits ineffective.
In this regard, Article 21 of the CPCA states: “Interim relief shall be appropriate when the implementation or continuation of the conduct subject to the proceedings causes serious current or potential damage or harm to the asserted position (...)”. Therefore, whenever there is a danger of current or potential damage or harm to litigants’ substantive legal positions, interim protection must serve as a mechanism of protection and guarantee in order to preserve those legal positions in their entirety; this is further supported by the fact that litigants do not in every case seek mere monetary compensation, but primarily and fundamentally the integrity of their claim for relief and the legal position supporting it. c) Balancing of the interests at stake, or bilateral application of periculum in mora (bilateralidad del periculum in mora): Finally, for interim relief to be granted, Article 22 of the CPCA states that “(...) the respective court or judge shall give particular consideration to the principle of proportionality, weighing any potential harm to the public interest, the damage and harm caused to third parties by the measure, and the characteristics of instrumentality and provisionality, so that neither the entity’s substantive operations nor the legal position of third parties are seriously affected.
The court or judge shall also consider the financial resources and provisions that the Public Administration must arrange for the implementation of the interim relief.” Accordingly, when the harm that could be caused to the public interest or to the interests of third parties is greater than the harm the applicant for interim relief could suffer if the application were denied, the application must be rejected.
In accordance with the foregoing, the granting of the provisional measure (medida cautelar) requires the existence and concurrence of three prerequisites, namely, likelihood of success on the merits (apariencia de buen derecho), danger in delay (peligro en la demora), and the balancing of the interests at stake; if any one of them is absent, granting the measure is improper. It is now appropriate to analyze whether, in the present case, the three prerequisites are met in accordance with the arguments presented by the applicant and the evidence submitted for that purpose, under the terms set forth in Article 24 of the CPCA. The analysis therefore begins with the first prerequisite, likelihood of success on the merits, or fumus boni iuris. As indicated, this element consists of a hypothetical assessment of probability or plausibility derived not only from the seriousness of the claim, but also from the likelihood that the principal issue will be upheld; in this regard, that initial appearance of seriousness will suffice for this requirement to be deemed satisfied.
Article 21) of the CPCA requires that the claim not be frivolous or manifestly devoid of seriousness. In the present case, the plaintiff challenges the municipal administrative conduct, alleging a failure to fulfill the duty to supervise and protect the maritime-terrestrial zone (zona marítimo terrestre) and public-domain property (bienes demaniales), as well as a violation of the right to a healthy and ecologically balanced environment (art. 50 of the Constitution), and of the provisions of the Organic Environmental Law (Ley Orgánica del Ambiente), the Maritime-Terrestrial Zone Law (Ley sobre la Zona Marítimo Terrestre), and the Biodiversity Law (Ley de Biodiversidad), by allowing motor vehicles to enter the public area of the beach, and even of the Law on Traffic on Public Land Roads and Road Safety (Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial), insofar as it prohibits vehicular traffic on the beach.
In addition, the plaintiff alleges a violation of Article 10 of the regulations implementing the Ley sobre la Zona Marítimo Terrestre, because camping activities are tolerated in that same area, which in turn causes pollution, waste, and risks to health, human life, and personal safety; in support thereof, the plaintiff also invokes opinions of the Procuraduría General de la República and the Sala Constitucional. Accordingly, based on an assessment of probability, it may be stated that the claim is not frivolous, and this requirement is therefore deemed satisfied.
Second, it is appropriate to analyze the existence of serious, actual, or potential harm, known as periculum in mora, which the granting of the provisional measure is intended to prevent. The occurrence of serious, actual, or potential harm as a prerequisite for granting the provisional measure is provided for in Article 21 of the CPCA, which states that: “...The provisional measure shall be appropriate when the implementation or continuation of the conduct under judicial review causes serious actual or potential harm or injury to the asserted situation, provided that the claim is not frivolous or manifestly devoid of seriousness.” Under the cited article, for the provisional measure to be appropriate, the harm caused by the implementation or continuation of the challenged administrative conduct must be serious; that is, a mere allegation of harm is insufficient to grant the measure, as the harm must be substantiated or demonstrated and must also be serious.
Regarding proof of the harm, the Tribunal de Apelaciones de lo Contencioso Administrativo, Sección Primera, n° 170-2023-I del 05 de mayo del 2023, stated that the harm that may justify the granting of a provisional measure is harm classified as serious, actual, or potential and duly substantiated by the party, because the party alleging serious harm bears the burden of proving it, and a mere allegation is insufficient for these purposes. In the present case, the applicant alleges that, because Playa Zapotillal is a turtle nesting site and one of the most important sites in Costa Rica where the black turtle nests—which is endangered—the situation becomes critical when motor vehicles are allowed to enter the public area of the beach without any intervention whatsoever by the respondent municipality. The plaintiff states that there can be no doubt regarding the direct adverse effects and the extremely serious consequences caused by vehicular traffic in areas where turtles lay their eggs.
In this regard, the plaintiff submitted the study “Environmental Impact Assessment (Evaluación de Impacto Ambiental): Vehicular Traffic on Playa Conchal,” by biologist Gerardo Barboza Jiménez, which established that the significant impact factors resulting from vehicles entering the beach include: “(...) the removal of the original shrub and creeping vegetation at the high-tide line and berm. Severe impacts by subarea were found at the berm level: compaction and subsidence from the excessive weight of parked and moving vehicles, commerce, and services, as well as the removal of the original vegetation cover (cobertura vegetal): shrubs and creeping vegetation. At the dune level: the removal of the original vegetation cover consisting of herbaceous plants, shrubs, and trees; compaction, subsidence, and erosion caused by moving and parked vehicles; and adverse effects on the landscape.” It bears repeating that this occurs when vehicles enter the beach, a fact that was established not only by photographs submitted by the claimant (images 67 to 70 of the digital case file), but even by the respondent entity itself, because the photographic annex to official letter ZMT-7992022 shows vehicles in the public area of the beach and motor-vehicle tracks (image 49 of the digital case file, provisional-measures file); accordingly, the serious harm to the environment and animal species identified by the biologist is indeed potential but certain.
In addition, on 20 de diciembre de 2022, the Dirección de Áreas Silvestres Protegidas del Área de Conservación Tempisque sent a memorandum to the Municipalidad de Santa Cruz stating: “(...)Nevertheless, threats to critical sea-turtle nesting sites persist and increase depending on the time of year, as occurs at the sites known as Playas Nombre de Jesús-Zapotillal, Real y Onda, where threats such as vehicles entering nesting beaches, the uncontrolled use of bonfires, camping without basic services such as water or sanitation facilities, the use of lights directed toward the beach, excessive noise, solid waste left on the beaches, and the looting of eggs are frequent and have fatal effects on the sea turtles that visit these beaches. If these activities continue without any oversight or without spatial land-use planning (ordenamiento espacial del territorio) to help minimize their impact, they will have adverse effects on the status of the population of sea turtles nesting at these sites.” It is clear that SINAC identified the existing risk to the environment and to turtles posed by motor vehicles entering the public area, as well as by uncontrolled camping and bonfire activities conducted without regulation or authorization from public entities.
This is therefore not just any type of risk, but a serious and egregious one involving the environment and biodiversity—areas in which this judge is fully aware of the need for State protection and intervention, as well as of the important role that ordinary judges have in protecting fundamental rights in order to conduct conventionality review (control de convencionalidad) and protect animal species, particularly when they are endangered, as is the black turtle. Accordingly, the precautionary principle (principio precautorio) in environmental matters, established in the Rio Declaration on Environment and Development (Declaración de Río Sobre el Medio Ambiente y el Desarrollo), applies to the subject matter of this provisional-measures proceeding and provides: “PRINCIPLE 15. In order to protect the environment, States shall broadly apply the precautionary approach according to their capabilities.
Where there is a danger of serious or irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.” This applies with particular emphasis in the context of this proceeding, in which the entry of vehicles into the public area of Playa Zapotillal has been established and, as a result of such entry, the carrying out of activities within the public area of the beach and the use of vehicles on the beach are imminent and certain, thereby creating a serious risk of grave harm to animal species, biodiversity, and the environment. Consequently, this prerequisite has been duly substantiated.
Lastly, in balancing the interests at stake (bilaterality of periculum in mora), this judge does not consider that granting the provisional measure would place public or third-party interests at risk. Quite the contrary: the measure adopted protects the maritime-terrestrial zone, safeguards the environmental interest, protects animal species such as turtles, and prevents harm to their eggs and nesting activities. This being so, the analysis must enhance the public interest and third-party interests when it is aimed precisely at directing administrative conduct toward that objective. Therefore, this prerequisite is deemed satisfied.
In addition to the foregoing, the provisional measure is urgent because the entry of vehicles onto the beach is imminent and poses a certain and actual risk; it is temporary because it is granted until the judgment on the merits is issued; it is ancillary to the subject matter or merits of the proceeding; and it is granted on the basis of a summary examination (sumaria cognitio), as is characteristic of this type of matter.
V.REGARDING THE REQUEST TO JOIN NECESSARY PASSIVE CO-LITIGANTS (LITISCONSORCIO PASIVO NECESARIO) SUBMITTED BY THE RESPONDENT ENTITY: The Municipalidad de Santa Cruz requested that the State, Sinac, Minae, Dirección de Policía de Tránsito, Ministerio de Seguridad Pública and Fuerza Pública be joined as parties. In this regard, this judge considers that the request made by the municipal corporate entity must be denied: first, because this matter is a summary provisional-measures proceeding in which defenses or objections unrelated to the subject matter of the provisional measure may not be raised; additionally, because this Court, on its own motion, afforded the State and SINAC an opportunity to be heard, while the other bodies identified by the respondent lack instrumental legal personality (personalidad jurídica instrumental) enabling them to appear as respondents (art. 12.3 CPCA); and, finally, because the subject matter of the request for provisional relief does not affect them, since the entity against which the claim is brought is the Municipalidad de Santa Cruz.
Consequently, in accordance with the foregoing considerations, the provisional measure requested by the appellant is granted.
POR TANTO
The request for a provisional measure filed by Mr. Claudio Donato López, in his capacity as special judicial attorney-in-fact (apoderado especial judicial) for Punta Sabana Developments, Ltda, legal entity identification number (cédula jurídica) n° 3-102-704182, against the Municipalidad de Santa Cruz is granted.
Consequently, and given that in provisional relief (tutela cautelar) there need not be congruence between the specific relief requested and the relief ultimately granted by the judge, the Municipalidad de Santa Cruz is ORDERED to do the following:
The undersigned judge wishes to clarify that, under the terms of what is ordered in this ruling, the Municipalidad de Santa Cruz must install physical barriers that effectively and genuinely prevent motor vehicles from entering, traveling through, and parking in the beach’s maritime-terrestrial zone (zona marítimo terrestre); that is, this does not refer to signs warning that entry is prohibited, but rather to the installation of physical barriers for vehicles.
It is clarified that this interim ruling (decisión cautelar) must not, in any way, prevent entry and pedestrian access by persons wishing to walk to Playa Zapotillal.
For purposes of compliance with this interim ruling, it is also ordered that the Municipalidad de Santa Cruz and its respective municipal police may request assistance from the Fuerza Pública if necessary, since through this ruling the Fuerza Pública is also ordered to provide the necessary assistance so that this interim order (orden cautelar) is effectively complied with.
Finally, this interim measure (medida cautelar) is ordered to be complied with immediately by the Municipalidad de Santa Cruz and, personally, Mr. Jorge Alfaro Orias, identification card 5-0262-0256, in his capacity as Municipal Mayor, is ordered to adopt it and ensure its effective compliance. EL ESTADO Nº N° 2023005608 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las dieciocho horas con siete minutos del veinte de Noviembre del dos mil veintitres.- Medida cautelar solicitada por el señor Claudio Donato López, en su condición de apoderado especial judicial de la sociedad Punta Sabana Developments, Ltda, cédula jurídica n° 3-102-704182, contra la Municipalidad de Santa Cruz.
RESULTANDO:
Al mismo tiempo, otorgó audiencia a la entidad demandada y puso en conocimiento al Estado y al Sinac, para que se apersonaran si a bien lo tenían. (Imagen 30 del expediente digital, legajo cautelar).
CONSIDERANDO;
La parte actora indica que Playa Zapotillal (conocida como Playa Minas) es reconocida por la anidación de tortugas y que ella, la actora, posee un inmueble en los alrededores de dicha playa. Comenta que, actualmente y debido a la omisión de la corporación municipal demandada, no existe impedimento para el ingreso y circulación de vehículos automotores en la zona pública de la zona marítimo terrestre, con lo cual, se afecta gravemente a las tortugas, sobre todo a la tortuga negra, sus huevos y anidación. Acusa que a la playa están ingresando gran cantidad de personas y vehículos automotores, incluso de personas que se dedican a actividades de comercio (tours en cuadraciclo), que generan una afectación directa a las áreas de anidación de tortugas y a la cría de huevos, por actividades nocturnas de la misma naturaleza. De esa forma, la actora señala que con el ingreso de vehículos a la playa, a la zona pública de la zona marítimo terrestre, hay destrucción de nidos de tortugas y de huevos, daño a las tortugas, imposibilidad de crear nidos para ellas y afectación a su ecosistema.
Además de eso, la actora indica que existen actividades de campamento en la playa, sin autorización municipal, lo cual genera afectación ambiental por desechos que dejan las personas que ingresan con sus vehúculos, también de aquellos que acampan, sin que tampoco haya servicios básicos y con un alto riesgo de incendio forestal con afectación mayor a la flora y fauna por fogatas que se realizan por esas personas, lo cual, también se da por la tolerancia de la municipalidad demandada. Por ello, la parte actora solicita lo siguiente: "(...) Solicitamos que como medida cautelar, se ordene a la Municipalidad de Santa Cruz, que de manera inmediata proceda a impedir el tránsito y estacionamiento de vehículos automotores por la zona marítimo terrestre de playa Zapotillal. Para lo anterior, deberá disponer y mantener los obstáculos que impidan el acceso e ingreso de vehículos a la zona pública. Además, deberá asegurar que las barreras impidan el tránsito de los vehículos automotores, pero no el libre acceso peatonal de las personas que quieran ingresar a Playa Zapotillal.
Dicha medida cautelar deberá mantenerse durante todo el tiempo que dure la resolución definitiva de la presente demanda." (Imagen 24 del expediente digital, legajo cautelar). Por su parte, la Municipalidad de Santa Cruz manifestó que colocó rotulos que prohíben el paso en Playa Zapotillal y que se realizarán operativos policiales para impedir el ingreso de vehículos a la zona pública de la playa. Además, solicitó que se integre la litis con el Estado, Sinac, Minae, Dirección de Policía de Tránsito, Ministerio de Seguridad Pública y Fuerza Pública. Finalmente, alegó que no ha sido omisa en la protección de la zona marítimo terrestre.
La justicia cautelar surge del contenido general de la garantía constitucional a una justicia pronta y cumplida (artículo 41 de la Carta Magna) y comprende el derecho de solicitar al órgano jurisdiccional todas aquellas medidas cautelares que resulten necesarias, idóneas y pertinentes, para garantizar la eficacia de la sentencia de mérito, así como la satisfacción anticipada y provisional de las situaciones jurídicas sustanciales de los justiciables. La justicia cautelar busca mesurar o atemperar los efectos de la duración normal del proceso judicial, de modo que las situaciones jurídicas de las personas no se vean dañadas, desmerecidas o perjudicadas por efecto de la duración misma del proceso. De ahí que, sea plenamente aplicable el principio Chiovendano cuando señala que “La necesidad de servirse del proceso para obtener la razón, no debe ser un daño para quien probablemente tiene la razón.” De forma correlativa, el Juez está en la obligación de ordenar o adoptar las medidas cautelares que sean adecuadas y necesarias para tales efectos.
Así, la tutela cautelar es exigible cuando existe riesgo de que, en forma efectiva o potencialmente cierta, puedan desaparecer, dañarse o perjudicarse, en forma grave e incluso, irremediable, las situaciones jurídicas sustanciales aducidas por el promovente. En esos términos, es claro que la justicia cautelar facilita el adecuado ejercicio de la pronta y cumplida función jurisdiccional y de forma paralela, mantiene incólume tanto el objeto del proceso, esto es, la pretensión, así como la respectiva situación jurídica sustancial que se solicita proteger, durante el tiempo necesario para que se desarrolle en forma adecuada el proceso de fondo.
Los presupuestos esenciales e indispensables para la procedencia de una medida cautelar son (i) La apariencia de buen derecho, (ii) El peligro en la demora y (iii) la ponderación de los intereses en juego; veamos: a) La apariencia de buen derecho o fumus boni iuris: Consiste en un juicio hipotético de probabilidad o verosimilitud derivada no solo de la seriedad de la demanda, sino de la probabilidad del acogimiento de la cuestión principal; en tal sentido, se considera que bastará con esa apariencia inicial de seriedad, para que se tenga por cumplido con este requisito. El fumus boni iuris, busca la verificación de falta de temeridad de la pretensión y un viso, al menos inicial y razonable, de seriedad de la demanda. El Tribunal de Casación de lo contencioso administrativo en su voto No. 96-F-TC-2009, se refirió a este presupuesto también como el fumus non mali iuris, es decir, como la apariencia de que no hay un mal derecho en ejercicio. b) Peligro en la demora o periculum in mora: Consiste en el temor o peligro, objetivamente constatable, de que la tardanza en desarrollar el proceso principal, apareje la pérdida, desmejoramiento o la frustración de la situación jurídica sustancial aducida, lo cual iría unido a la inutilidad de la sentencia de mérito en tales supuestos.
Sobre el particular, el artículo 21 del CPCA indica que: "La medida cautelar será procedente cuando la ejecución o permanencia de la conducta sometida a proceso, produzca graves daños o perjuicios, actuales o potenciales de la situación aducida(...)”. Por ello, siempre que exista peligro de daño o perjuicio, actual o potencial, de las situaciones jurídicas sustanciales de los justiciables, la tutela cautelar debe fungir como mecanismo de protección y de garantía, con el fin de conservar íntegramente tales situaciones jurídicas; lo anterior, aunado a que no en todos los casos el justiciable pretende la mera reparación indemnizatoria, sino primaria y fundamentalmente, la integridad de su pretensión y de la situación jurídica que la sustenta. c) Ponderación de los intereses en juego o bilateralidad del periculum in mora: Finalmente, para que sea procedente otorgar una medida cautelar, el artículo 22 del CPCA señala que “(…) el tribunal o el juez respectivo deberá considerar, especialmente, el principio de proporcionalidad, ponderando la eventual lesión al interés público, los daños y los perjuicios provocados con la medida a terceros, así como los caracteres de instrumentalidad y provisionalidad, de modo que no se afecte la gestión sustantiva de la entidad, ni se afecte en forma grave la situación jurídica de terceros.
También deberá tomar en cuenta las posibilidades y previsiones financieras que la Administración Pública deberá efectuar para la ejecución de la medida cautelar". De ese modo, cuando el daño que pueda provocarse al interés público o a los intereses de terceros, sea de mayor envergadura que el que podría sufrir el promovente de la medida cautelar en caso de ser declarada sin lugar, ésta debe ser rechazada.
De conformidad con lo expuesto supra, para que se otorgue la medida cautelar, se requiere la existencia y concurrencia de tres presupuestos, a saber, apariencia de buen derecho, peligro en la demora y ponderación de intereses en juego, y a falta de uno ellos, deviene en improcedente el otorgamiento de la medida. Corresponde ahora analizar si en el presente caso concurren los tres presupuestos conforme a los argumentos señalados por el gestionante y la prueba aportada a los efectos, en los términos que lo indica el artículo 24 del CPCA. Se inicia, entonces, por analizar el primer presupuesto que es la apariencia de buen derecho, o fumus boni iuris. Tal y como se indicó, este extremo consiste en un juicio hipotético de probabilidad o verosimilitud derivada no solo de la seriedad de la demanda, sino de la probabilidad del acogimiento de la cuestión principal; en tal sentido se considera que bastará con esa apariencia inicial de seriedad, para que se tenga por cumplido con este requisito.
El artículo 21) del CPCA exige que la pretensión no sea temeraria, o palmariamente, carente de seriedad. En el presente caso, la parte actora cuestiona la conducta administrativa municipal, respecto de la que alega omisión en el cumplimiento de la debida fiscalización y protección de la zona marítimo terrestre y de los bienes demaniales, además de vulneración al derecho a un medio ambiente sano y ecológicamente equilibrado (art. 50 constitucional), así como las previsiones de la Ley Orgánica del Ambiente, Ley sobre la Zona Marítimo Terrestre y la Ley de Biodiversidad, al permitir el ingreso de vehículos automotores al área pública de la Playa, e, inclusive, de la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial, en tanto prohiben el tránsito de vehículos en la playa. Además, acusa la lesión del artículo 10 del reglamento a la Ley sobre la Zona Marítimo Terrestre, al tolerarse la realización de actividades de campamento en la misma zona, lo cual, a su vez, provoca contaminación, desechos, riesgos de salud, a la vida humana y a la seguridad de las personas, para lo cual, además invoca criterios de la Procuraduría General de la República y de la Sala Constitucional. De modo tal que, en grado de probabilidad, se puede afirmar que la pretensión no es temeraria por lo que se tiene por cumplido este requisito.
En segundo lugar, corresponde analizar la existencia del daño grave, actual o potencial, conocido como periculum in mora. que se pretende evitar con el otorgamiento de la medida cautelar. Y es que la realización de un daño grave, actual o potencial, como supuesto para el otorgamiento de la medida cautelar, se encuentra previsto en el artículo 21 del CPCA, en cuanto establece que "...La medida cautelar será procedente cuando la ejecución o permanencia de la conducta sometida a proceso, produzca graves daños o perjuicios, actuales o potenciales, de la situación aducida, y siempre que la pretensión no sea temeraria o, en forma palmaria, carente de seriedad". Conforme al citado artículo, para que proceda la medida cautelar se requiere que el daño provocado con la ejecución o permanencia de la conducta administrativa cuestionada, sea grave, es decir, no basta para el otorgamiento de la medida la mera alegación del daño, sino que se requiere acreditar o demostrar el daño y además que este daño sea grave.
Ahora, en cuanto a la acreditación del daño, el Tribunal de Apelaciones de lo Contencioso Administrativo, Sección Primera, n° 170-2023-I del 05 de mayo del 2023, señaló que el daño que puede originar el otorgamiento de una cautelar, es el calificado como grave, actual o potencial, debidamente acreditado por la parte, ya que es carga probatoria de quien alega el sufrimiento del daño grave, su demostración, no bastando a estos efectos, su mera alegación. En el presente caso, la parte gestionante alega que siendo Playa Zapotillal un sitio de anidación de tortugas, y uno de los sitios más importantes en Costa Rica donde anida la tortuga negra (la cual está en peligro de extinción), la situación se torna crítica al permitirse el ingreso de vehículos automotores en la zona pública de la playa, sin intervención en lo absoluto de la municipalidad demandada. Indica la actora que no existe ningún margen de dudas respecto a la afectación directa y los efectos gravísimos que genera la circulación de vehículos en áreas donde desovan tortugas.
Sobre el particular, la parte actora aportó que el estudio “Evaluación de Impacto Ambiental: Tránsito Vehicular en Playa Conchal” del biólogo Gerardo Barboza Jiménez, estableció que dentro de los factores de impacto de importancia del ingreso de vehículos a la playa se encuentra: “(…) la eliminación de la vegetación arbusiva y rastrera original a nivel de pleamar y berma. De importancia severa por subzona, se encontró, a nivel de berma: La compactación y hundimientos por sobrecarga de vehículos estacionados y en tránsito, comercio y servicios; así como la eliminación de cobertura vegetal original: arbusiva y rastrera. A nivel de dunas: la eliminación de cobertura vegetal original: herbáceas, arbustos y árboles; la compactación, hundimientos y erosión por tránsito y estacionamiento de vehículos; y la afectación del paisaje.” Se reitera, ello, con el ingreso de vehículos a la playa, lo cual, no solo fue acreditado por fotografías ofrecidas por la accionante (imagénes 67 a 70 del expediente digital), sino que, incluso fue probado por la propia entidad demandada, cuando en el anexo fotográfico del oficio ZMT-7992022, se aprecian imágenes de vehículos en la zona pública de la playa y huellas de vehículos automotores (imagen 49 del expediente digital, legajo cautelar), con lo cual, en efecto, el daño grave al medio ambiente y a especies animales, señalado por el biólogo, es potencial pero cierto.
Aunado a ello, en fecha 20 de diciembre de 2022, la Dirección de Áreas Silvestres Protegidas del Área de Conservación Tempisque, remitió una nota a la Municipalidad de Santa Cruz, en la que señaló: “(…)Sin embargo, las amenazas a los sitios críticos para la anidación de las tortugas marinas aún persisten y dependiendo de la época del año, se incrementan, tal es el caso de lo que ocurre en los sitios conocidos como Playas Nombre de Jesús- Zapotillal, Real y Onda, donde amenazas como el ingreso de vehículos a las playas de anidación, el uso sin control de fogatas, el camping sin contar con los servicios básicos como agua o servicios sanitarios, el uso de luces con dirección a playa, el exceso de ruidos, residuos sólidos que dejan en las playas, así como el saqueo de huevos, son frecuentes y afectan mortalmente a las tortugas marinas que visitan estas playas. De mantenerse el desarrollo de estas actividades sin ningún control o sin un ordenamiento espacial del territorio que ayude a minimizar el impacto, tendrá sus efectos negativos en el estado de la población de las tortugas marinas que anidan en estos sitios.” Claramente, se observa que el SINAC indicó el riesgo existente para el medio ambiente y para las tortugas, con el ingreso de vehículos automotores a la zona pública, así como con la realización de actividades de campamento y fogatas, sin control alguno, sin regulación y autorización de las entidades públicas, por lo que, no se trata de cualquier tipo de riesgo, sino de uno grave, grosero, pero, además, en el que está en juego el medio ambiente y la biodiversidad, siendo estos ámbitos respecto de los cuales, este juzgador es por completo consciente de la necesaria protección e intervención del Estado, así como de la relevante labor de tutela de los derechos fundamentales que poseemos los jueces ordinarios en aras de llevar a cabo el control de convencionalidad y la protección de las especies animales, sobre todo cuando están en peligro de extinción como la tortuga negra, de modo tal que, en el objeto del presente asunto cautelar resulta aplicable el principio precautorio en materia ambiental, establecido en la Declaración de Río Sobre el Medio Ambiente y el Desarrollo, que establece: "PRINCIPIO 15.
Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave o irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente." Lo anterior, con especial énfasis en el contexto de este proceso, en el que está acreditado el ingreso de vehículos a la zona pública de Playa Zapotillal y que, a partir de ese ingreso, es inminente pero cierto la realización de actividades dentro de la zona pública de la playa, la utilización del vehículo en la playa y con ello, el serio riesgo de daño grave a las especies animales, a la biodiversidad y al medio ambiente. En consecuencia, se encuentra debidamente acreditado este presupuesto.
Por último, en la ponderación de intereses en juego (bilateralidad del periculum in mora), en este caso, este juzgador no estima que con el otorgamiento de la medida cautelar se ponga en riesgos los intereses públicos ni de terceros, sino todo lo contrario, con la cautelar que se adopta, se protege la zona marítimo terrestre, se tutela el interés medio ambiental, se resguarda a las especies animales como la tortuga y se evita la afectación a sus huevos y anidación; siendo ello así, el análisis debe potenciar el interés público y los de terceros, cuando se tiende precisamente a la ordenación de conductas administrativas que busquen ese objetivo. Por ende, este presupuesto sí se tiene por cumplido.
Sumado a lo anterior, la medida cautelar es urgente, dado que el ingreso de vehículos a la playa es inmimente, bajo un riesgo cierto, efectivo; es provisional pues se otorga hasta el dictado de la sentencia de mérito; es instrumental respecto del objeto del proceso o de fondo y se otorga bajo una sumaria cognitio, propia de este tipo de asuntos.
La Municipalidad de Santa Cruz solicitó que se integre la litis con el Estado, Sinac, Minae, Dirección de Policía de Tránsito, Ministerio de Seguridad Pública y Fuerza Pública. Al respecto, este juzgador estima que lo solicitado por la entidad corporativa municipal debe rechazarse, primero, porque este asunto es un proceso sumario cautelar, donde no cabe la interposición de defensas ni oposiciones distintas al objeto cautelar; aunado a ello, porque este Tribunal otorgó audiencia, de oficio, al Estado y al SINAC, siendo que, en relación con los demás órganos que se indicó por la demandada, no poseen personalidad jurídica instrumental que les permita comparecer como parte demandada (art. 12.3 CPCA) y, finalmente, porque el objeto de la pretensión cautelar no les afecta, siendo que la persona respecto de la cual se plantea la pretensión, es la Municipalidad de Santa Cruz.
En consecuencia, de acuerdo con las consideraciones antes expuestas, se admite la medida cautelar solicitada por la parte recurrente.
POR TANTO
Se acoge la solicitud de medida cautelar formulada por el señor Claudio Donato López, en su condición de apoderado especial judicial de la sociedad Punta Sabana Developments, Ltda, cédula jurídica n° 3-102-704182, contra la Municipalidad de Santa Cruz.
En consecuencia y, siendo que en la tutela cautelar no existe congruencia entre lo puntualmente solicitado y lo finalmente otorgado por el juzgador, se ORDENA a la Municipalidad de Santa Cruz lo siguiente:
El suscrito juzgador desea aclarar que, en los términos de lo que se ordena en esta resolución, la Municipalidad de Santa Cruz debe colocar obstáculos materiales que impidan efectiva y realmente el ingreso, el tránsito y estacionamiento de vehículos automotores en la zona marítimo terrestre de la playa; es decir, no se trata de rótulos que alerten de impedimento de ingreso, sino que se ordena la colocación de obstáculos materiales para vehículos.
Se aclara que la presente decisión cautelar no debe, en modo alguno, impedir el ingreso y acceso peatonal de las personas que deseen ingresar caminando a Playa Zapotillal.
Para efectos del cumplimiento de la presente resolución cautelar, se dispone también que la Municipalidad de Santa Cruz y su respectiva policía municipal, pueden solicitar el auxilio de la Fuerza Pública en caso de ser necesario, pues a través de esta resolución, también se le ordena a la Fuerza Pública brindar la colaboración necesaria, para que la presente orden cautelar sea efectivamente cumplida.
Finalmente, esta medida cautelar se dispone de cumplimiento inmediato para la Municipalidad de Santa Cruz y, en lo personal, se le ordena su adopción y cumplimiento efectivo al señor Jorge Alfaro Orias, cédula de identidad 5-0262-0256, en su condición de Alcalde Municipal, a quien se le apercibe que, en caso de incumplimiento, no solamente se remitirá el expediente al Área de Ejecución de este Tribunal para que se ordene el cumplimiento coactivo de lo aquí dispuesto, sino que también, se testimoniarán piezas por el delito de desobediencia a la autoridad, previsto en el artículo 314 del Código Penal.
