(Acting in place of the Criminal Judgment Appeals Court of Guanacaste, Santa Cruz seat) Goicoechea, at thirteen hours and five minutes on the twenty-fifth of October of two thousand twenty-three.- APPEAL filed in the present proceedings against [Name 001], of legal age, single, Nicaraguan, identity document [...], 53 years of age, born on 02 de enero de 1970, son of [Name 002] and [Name 003], resident of Guanacaste, for the offense of VIOLATION OF THE FISHERIES AND AQUACULTURE LAW, IN THE FORM OF ENGAGING IN COMMERCIAL OR SPORT FISHING IN NATIONAL PARKS, NATURAL MONUMENTS, AND BIOLOGICAL RESERVES, to the detriment of NATURAL RESOURCES. Judge Helena Ulloa Ramírez and associate judges Jorge A. Camacho Morales and Wilson Flores Fallas participated in deciding the appeal. Attorney Zaray Chavarría Prado appeared before this Court in her capacity as State Attorney.

BACKGROUND:

I.By judgment number 511-2023, issued at fifteen hours and thirty minutes on primero de setiembre del año dos mil veintitré, the Liberia Flagrante Delicto Criminal Court ruled: “POR TANTO: In accordance with the foregoing and Articles 39 and 41 of the Political Constitution; 1, 18, and 30 of the Criminal Code; 1, 2, 3, 4, 373, and 374 of the Code of Criminal Procedure; the Fee Schedule for Professional Legal and Notarial Services; and Article 96 bis of the Organic Law of the Judicial Branch; THE EXPEDITED PROCEEDING (PROCEDIMIENTO ABREVIADO) IS APPROVED, AND CONSEQUENTLY [Name 001] IS FOUND CRIMINALLY RESPONSIBLE AS THE PERPETRATOR of the offense of VIOLATION OF THE FISHERIES AND AQUACULTURE LAW, IN THE FORM OF ENGAGING IN COMMERCIAL OR SPORT FISHING IN NATIONAL PARKS, NATURAL MONUMENTS, AND BIOLOGICAL RESERVES, committed to the detriment of HYDROBIOLOGICAL RESOURCES, and in that capacity is sentenced to FOURTEEN BASE SALARIES, the amount of which, on the date of the acts, was fixed at four hundred sixty-two thousand two hundred colones exactly (¢ 462,200.00); accordingly, he shall pay a total of SIX MILLION FOUR HUNDRED SEVENTY THOUSAND EIGHT HUNDRED COLONES EXACTLY (¢6.470800.00), which shall be deposited in the proportion of fifty percent (50%) in favor of Incoopesca into account number 100-01-03-005793-2 at Banco Nacional de Costa Rica, and the remaining fifty percent (50%) in favor of Servicio Nacional de Guardacostas into account 100-01-0002-15933-3 at Banco Nacional de Costa Rica.

The convicted person shall make the corresponding deposit once this decision becomes final, without prejudice to the enforcement of attachments and judicial sales in the event of noncompliance. The convicted person is also ordered to surrender the corresponding fishing licenses for cancellation. Furthermore, THE CIVIL DAMAGES ACTION (ACCIÓN CIVIL RESARCITORIA) IS GRANTED in full, and consequently the civil defendant, [Name 001], is ordered to pay TWO MILLION TWO HUNDRED SEVENTY-THREE THOUSAND FORTY COLONES AND SEVENTY-TWO CÉNTIMOS (2.273040.72) for environmental damage, which shall be deposited in favor of the State’s single treasury account, client account number 15201001024247624 at Banco de Costa Rica. Because the civil action was granted in full, the civil defendant is ordered to pay personal legal costs in the amount of FOUR HUNDRED FIFTY-FOUR THOUSAND SIX HUNDRED EIGHT COLONES AND FOURTEEN CÉNTIMOS (¢ 454,608.14), which he shall deposit in favor of the State’s single treasury account, client account number 15201001024247624 at Banco de Costa Rica. [Name 001] is ordered to pay the default interest accrued on all sums ordered herein.

This matter is resolved without a special award of costs regarding the public prosecution; once the judgment becomes final, it shall be communicated to the Sentence Enforcement Judge, and the customary certified copies shall be prepared for submission to the Registro Judicial and the

Instituto Nacional de Criminología. The permanent return of the vessel Dorka II, Registration [Value 003], and its corresponding Yamaha engine, model F75CEDL, NUMBER 6BC1001884, to the person appearing as its lawful owner is ordered. The parties are hereby notified, and a digital copy of this judgment is made available to them.-” (sic)

II. Attorney Zaray Chavarría Prado, in her capacity as State Attorney, filed an appeal against the foregoing decision

III.After the corresponding deliberation was conducted in accordance with Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal.

IV. The relevant legal requirements have been observed in the proceedings

Appellate Judge Ulloa Ramírez drafts the decision; and,

CONSIDERING:

I.Jurisdiction of this Court to hear this appeal from the judgment: In accordance with the resolutions adopted by the Full Court in sessions number 33-2022 of 21 de abril de 2022, Article XLIV; 22-2022 of 16 de mayo de 2022, Article XXXIV; and 28-2023 of 26 de junio de 2023, Article XVIII, the jurisdiction of this Juvenile Criminal Judgment Appeals Court, seated in the Second Judicial Circuit of San José, was expanded to hear applications for extensions of pretrial detention (prisión preventiva) and appeals from judgments falling within the jurisdiction of the Criminal Judgment Appeals Court of Guanacaste, throughout 2023 and until 9 de enero de 2024. For that reason, this Court proceeds to hear and decide the merits of the appeal.

II.Failure to comply with the duty to state reasons regarding forfeiture (comiso). As the sole ground of the appeal from the judgment, Attorney Zaray Chavarría Prado, Criminal State Attorney, appeals judgment number 511-2023, issued at 15:30 hours on 1° de setiembre de 2023 by the Flagrante Delicto Court of the First Judicial Circuit of Guanacaste, Liberia. As her sole ground, she claims that the judgment fails to comply with the duty to state reasons, particularly with respect to forfeiture. She explains that, in this case, the Procuraduría General de la República sought the forfeiture of the vessel Dorka II, Registration [Value 003], and its corresponding Yamaha-brand engine, model F75EDL, Number 68C1001884, the vessel in which the accused was traveling when he entered the protected waters of Parque Nacional Santa Rosa. The judgment ordered that the vessel be delivered to the person appearing as its lawful owner.

The appellant considers that decision to be unsupported by reasons. After quoting excerpts from the judgment and its operative portion (parte dispositiva), she alleges failure to observe Article 103(3) of the Criminal Code and Article 142 of the Code of Criminal Procedure, insofar as forfeiture is a consequence of the offense which, she asserts, is an “automatic consequence” because its application is neither optional nor discretionary; rather, the adjudicating judge must order forfeiture when the circumstances established by law are present. She relies on decision number 2020-01243, issued at 12:41 hours on 25 de setiembre de 2020, from which she quotes an excerpt and derives the mandatory nature of ordering forfeiture of the instruments, objects, or assets used in committing the act or obtained from it, because it is one of the civil consequences of the offense and, once the offense has been established, forfeiture is warranted.

In her view, the judgment violates the applicable law and the relevant line of precedent because it failed to explain why it did not order forfeiture of the vessel and instead ordered its return to the person appearing as its lawful owner. She considers that the decision causes prejudice because it plainly lacks reasoning concerning the order to return the aforementioned property and, conversely, the failure to order its forfeiture. Position of the defense and the Ministerio Público: After notice of the hearing on the challenge was served, the record contains no response from either the accused’s defense or the prosecution.

II.The appeal is denied. The appellant bases her claims on the nature of forfeiture (comiso), as a civil consequence arising from the offense, which is mandatory—that is, a legal obligation that must be declared in the judgment once the existence of the criminal act has been established. Indeed, Title VII of the Criminal Code, concerning the Civil Consequences of the punishable act, includes forfeiture among them in section 103.3. Article 110 develops this concept and provides: “The offense results in the loss to the State of the instruments with which it was committed and of the things or assets derived from its commission, or which constitute a benefit obtained by the perpetrator from the offense itself, without prejudice to any rights that the victim or third parties may have in them. Vehicles involved in the commission of the acts defined in section 261 bis of the Criminal Code are excluded from this provision” (emphasis added).

This provision, which the appellant does not mention, is precisely what protects the rights of third parties or the victim in such objects, instruments, or assets against forfeiture. A review of the civil action for damages (acción civil resarcitoria) filed by the Procuraduría General de la República, appearing at pages 67 to 72 of the main case file, as well as the documentary evidence it offered—including Certificate of Seaworthiness No.22485, dated 14 de febrero de 2022, issued to [Nombre 004]—shows that he is the registered owner of the vessel Dorka II, registration GPC 8821, with the serial and engine numbers previously stated, as also recorded in the Registro Público certification appearing at pages 130 and 131. Mr. [Nombre 004] was not formally joined as a party, an interested third party, or a third-party civil defendant (tercero civilmente demandado). Nor was it alleged, either among the facts set forth in the civil action for damages or in the indictment, that Mr. [Nombre 004] had any degree of knowledge, whether direct or constructive, or even arising from carelessness or negligence, from which it could be inferred that he knew of, consented to, or tolerated the defendant’s unlawful conduct in using his vessel to enter the waters of the protected area of Parque Nacional Santa Rosa in order to engage in prohibited fishing activities.

Mr. [Nombre 004] holds a fishing license under file 504060718 of the Instituto Nacional de Pesca y Acuacultura, valid from 9 de julio de 2021 to 13 de agosto de 2024 (original at page 133). In this regard, the owner appeared in the proceedings to insist that the vessel be returned to him or that he be appointed its provisional custodian (depositario provisional), and in his applications he explained that he had no idea why the defendant had committed that act, that the vessel was deteriorating, and that he was its lawful owner. His ownership has not been disproved in these proceedings, and the appeal does not even address that essential and highly relevant fact, particularly because it concerns respect for the fundamental right to property in the face of the State’s sovereign authority (potestad de imperio) to take ownership of property, instruments, or proceeds derived from an unlawful act.

Thus, when the owner of the seized vessel appeared in the proceedings, he learned that it had been seized and stated that it belonged to him; this does not mean that he had been afforded a hearing or notified of the possibility that the property might be forfeited and of his right to defend himself. Even the Procuraduría General de la República itself was informed of Mr. [Nombre 004]’s request for the vessel’s return or, at least, for provisional custody, as shown at page 140. This was ordered by the court, which in turn directed that notice of these proceedings be entered in the registration record of the vessel (page 137, ruling issued at 9:48 hours on 19 de agosto de 2023), because it was evident that this movable property was deteriorating while seized and without safekeeping or use. Indeed, a review of the claims shows that the appellant fails even to consider these essential facts: first, that the vessel did not belong to the defendant, which plainly required additional verification and procedural steps that were not undertaken; and second, whether, in any event, the request bore any proportional relationship to the proven act and the environmental damage, and whether the vessel could in fact be considered an “instrument” used to commit the offense, since navigation alone is not a prohibited activity in the waters of Parque Nacional Santa Rosa.

Rather, what is prohibited is any exploitation of flora and fauna, including marine flora and fauna, and illegal fishing. Accordingly, the items used to carry out the unlawful fishing, to the detriment of the environment, could be regarded as instruments. Thus, even by applying, in bonam partem, the exception provided in that same Article 110 of the Criminal Code, motor vehicles are excluded from forfeiture when the alleged conduct is reckless driving, conduct that in itself poses a risk to the physical integrity and lives of third parties. Applying that exception by analogy to the case before us, a vessel is not in itself an instrument but rather a means of transportation, and its forfeiture could be manifestly disproportionate in cases of illegal fishing, particularly small-scale fishing as in this case, although this does not negate the environmental damage. The situation could be different for vessels used for human trafficking, migrant smuggling, or the transportation of weapons or drugs, since the legally protected interests (bienes jurídicos) involved and the risks to the victims’ lives and physical integrity justify the forfeiture of an instrument directly used to transport persons under those conditions, or to transport weapons or drugs.

Notwithstanding the foregoing, in this specific case the State representative seeks forfeiture of the vessel, which, as stated, belongs to a third party. As noted, a review of the indictment and the pleading containing the civil action for damages does not attribute to the vessel’s owner any intentional or negligent act, or any liability arising from a legal provision, that would justify the loss to the State of property belonging to him. It is true that the judgment does not state the grounds for the decision to return the vessel to the person who proves to be its lawful owner—something that, in fact, has already been established in the record—but that deficiency affects Mr. [Nombre 004], who has sufficiently proven ownership of the property and who even holds it in his capacity as custodian. Furthermore, cancellation of the notice of these proceedings was not ordered either, a defect that prejudices not the State but the owner.

Under these circumstances, the nature of forfeiture as a civil consequence arising from the offense and its mandatory character do not apply against third parties holding rights, as is the case here. Therefore, pursuant to section 45 of our Constitution, together with the provision of section 110 of the Criminal Code, the appeal filed must be denied. The Tribunal de Flagrancia del Primer Circuito Judicial de Liberia shall cancel the notice entered in the registration record of the vessel Dorka II, registration [Valor 003], Yamaha F75CEDL engine, number 68C1001884, registered in the name of [Nombre 004], and shall undertake the steps necessary to return it to its owner.

POR TANTO:

The appeal against the judgment filed by the Procuraduría General de la República is denied. The Tribunal de Flagrancia del Primer Circuito Judicial de Liberia shall cancel the notice entered in the registration record of the vessel Dorka II, registration [Valor 003], Yamaha F75CEDL engine, number 68C1001884, registered in the name of [Nombre 004], and shall undertake the steps necessary to return it to its owner. I.Que mediante sentencia número 511-2023, de las quince horas treinta minutos del primero de setiembre del año dos mil veintitré, el Tribunal Penal de Flagrancia de Liberia, resolvió: "POR TANTO: De conformidad con lo expuesto, y los artículos 39 y 41 de la Constitución Política; 1, 18, 30, Código Penal; 1, 2, 3, 4, 373, 374 del Código Procesal Penal, Arancel de honorarios por servicios profesionales de abogacía y notariado, artículo 96 bis de la Ley Orgánica del Poder Judicial; SE ACOGE EL PROCEDIMIENTO ABREVIADO Y EN CONSECUENCIA SE DECLARA A [Nombre 001] autor responsable de un delito de INFRACCIÓN A LA LEY DE PESCA Y ACUICULTURA EN SU MODALIDAD DE EJERCICIO DE ACTIVIDAD DE PESCA COMERCIAL O DEPORTIVA EN PARQUESNACIONALES, MONUMENTOS NATURALES Y RESERVAS BIOLÓGICAS cometido en perjuicio de LOS RECURSOS HIDROBIOLÓGICOS y en tal carácter se le impone el tanto de CATORCE SALARIOS BASE, cuyo monto para la fecha de los hechos se encontraba fijado a razón de cuatrocientos sesenta y dos mil doscientos colones exactos (¢ 462,200.00) por lo que deberá cancelar un total de SEIS MILLONES CUATROCIENTOS SETENTA MIL OCHOCIENTOS COLONES EXACTOS(¢6.470800.00), monto que habrá de ser depositado en proporción de un cincuenta por cierto (50%) a favor de Incoopesca a la cuenta número 100-01-03-005793-2 del Banco Nacional de Costa Rica y el restante cincuenta por cierto (50%) a favor del Servicio Nacional de Guardacostas a la cuenta 100-01-0002-15933-3 del Banco Nacional de Costa Rica.

La persona sentenciada deberá realizar el depósito correspondiente a la firmeza de esta resolución, sin perjuicio de que en caso de incumplimiento se proceda con la ejecución de embargos y remates. Asimismo se condena al sentenciado a la cancelación de las licencias de pesca respectivas. Por otra parte, SE DECLARA CON LUGAR LA ACCIÓN CIVIL RESARCITORIA acogiéndose en su totalidad, y en consecuencia se condena al demandado civil [Nombre 001] al pago de DOS MILLONES DOSCIENTOS SETENTA Y TRES MIL CUARENTA COLONES CON SETENTA Y DOS CÉNTIMOS (2.273040.72) por concepto de daño ambiental el cual habrá de ser depositado a favor de la caja única del Estado a la cuenta cliente número 15201001024247624 del Banco de Costa Rica. Habiéndose acogido la acción civil en su totalidad se condena al demandado civil al pago de costas personales que corresponden a la suma de CUATROCIENTOS CINCUENTA Y CUATRO MIL SEISCIENTOS OCHO COLONES CON CATORCE CÉNTIMOS (¢ 454,608.14), los cuales deberá depositar a favor de la caja única del Estado a la cuenta cliente número 15201001024247624 del Banco de Costa Rica.

Se condena a [Nombre 001] al pago de los intereses moratorios devengados de todas las sumas aquí ordenadas. Se resuelve este asunto sin especial condenatoria en costas respecto de la acción pública, firme la sentencia se ordena comunicar la misma al Juez de Ejecución de la Pena, confecciónense los testimonios de estilo para ante el Registro Judicial y el

Instituto Nacional de Criminología. Se ordena la devolución definitiva de la embarcación Dorka II Matrícula [Valor 003] y su respectivo motor Yamaha modelo F75CEDL NÚMERO 6BC1001884 a quien figure como su legítimo propietario. Quedan notificadas las partes, queda a disposición de las mismas respaldo digital de la presente sentencia.-". (sic)

II.Que contra el anterior pronunciamiento interpuso recurso de apelación la licencida Zaray Chavarría Prado, en calidad de Procuradora.

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta la Jueza de Apelación Ulloa Ramírez; y,

CONSIDERANDO:

I.Competencia de este Tribunal para conocer de este recurso de apelación de sentencia: Conforme lo acordado por Corte Plena, en las sesiones número 33-2022 del 21 de abril de 2022, artículo XLIV, 22-2022, del 16 de mayo de 2022, artículo XXXIV y 28-2023, del 26 de junio de 2023, artículo XVIII, se dispuso ampliar la competencia de este Tribunal de Apelación de Sentencia Penal Juvenil, con sede en el Segundo Circuito Judicial de San José, para el conocimiento de las gestiones de prórroga de prisión preventiva y recursos de apelación de sentencia que sean competencia del Tribunal de Apelación de Sentencia Penal de Guanacaste, por todo el año 2023 y hasta el 9 de enero de 2024. Por esa razón entra este Tribunal a conocer y resolver el fondo del recurso.

II- Inobservancia del deber de motivación en cuanto al comiso. Como único motivo del recurso de apelación de sentencia, la licenciada Zaray Chavarría Prado, Procuradora Penal, interpone recurso de apelación en contra de la sentencia número 511-2023, de las 15:30 horas, del 1° de setiembre de 2023, dictada por el Tribunal de Flagrancia del Primer Circuito Judicial de Guanacaste, Liberia. Como único motivo reclama que la sentencia no cumple con el deber de motivación, en particular en cuanto se refiere al comiso. Explica que en este caso, era pretensión de la Procuraduría General de la República, que se ordenara el comiso de la embarcación Dorka II, Matrícula [Valor 003] y su respectivo motor marca Yamaha, modelo F75EDL Número 68C1001884, que es la embarcación en la que viajaba el acusado cuando ingresó a las aguas protegidas del Parque Nacional Santa Rosa. La sentencia dispuso entregar la embarcación a quien figure como su legítimo propietario.

La apelante estima que esa decisión no está fundamentada. Luego de transcribir extractos del fallo y de la parte dispositiva, reclama la inobservancia de lo que dispone el inciso 3 del artículo 103 del Código Penal y 142 del Código Procesal Penal, en cuanto a que el comiso es una consecuencia del delito, la que, afirma, es una "consecuencia automática" porque su aplicación no es de carácter facultativo o discrecional, sino que la persona juzgadora debe disponer el comiso cuando se den las circunstancias que la ley contempla. Se apoya en la resolución número 2020-01243 de las 12:41 horas, del 25 de setiembre de 2020, del que transcribe un extracto, del que deriva la obligatoriedad de disponer el comiso en relación con los instrumentos, cosas o valores que hayan sido utilizados en la realización del hecho o que provengan de él, pues es una de las consecuencias civiles del delito y, constatado éste, el comiso procede.

A su juicio, la normativa vigente y la línea jurisprudencial al respecto, resultan violentadas en la sentencia, que al contrario, no fundamentó por qué no ordenó el comiso de la embarcación y, al contrario, dispuso la devolución a quien figure como legítimo propietario. Considera que la decisión ocasiona un agravio dado que es evidente la falta de fundamentación en cuanto a la decisión de ordenar la devolución del mencionado bien y, por el contrario, no dispuso el comiso. Posición de la defensa y del Ministerio Público: Notificada la audiencia con motivo de la impugnación, no consta pronunciamiento ni de la defensa del acusado ni por parte de la fiscalía.

II.El recurso se declara sin lugar. La apelante basa sus reclamos en la naturaleza del comiso, como consecuencia civil derivada del delito, la que resulta imperativa, es decir, una obligación legal que debe ser declarada en sentencia, una vez constatada la existencia del hecho delictivo. En efecto, en el Título VII del Código Penal relativo a las Consecuencias Civiles del hecho punible, se contempla el comiso, en el numeral 103.3 como una de ellas. Es el artículo 110 el que lo desarrolla y señala "El delito produce la pérdida en favor del Estado, de los instrumentos con que se cometió y de las cosas o los valores provenientes de su realización, o que constituyan para el agente un provecho derivado del mismo delito, salvo el derecho que sobre ellos tengan el ofendido o terceros. Se excluyen de esta previsión, los vehículos involucrados en la comisión de los hechos tipificados en el numeral 261 bis del Código Penal" (resaltado suplido).

Esta norma, que no la menciona la impugnante, es precisamente la que permite resguardar del comiso, los derechos de terceras personas o de la víctima, sobre tales objetos, instrumentos o valores. La lectura de la acción civil resarcitoria planteada por la Procuraduría General de la República, que consta de folios 67 a 72 del principal, así como las pruebas documentales que ofreció, entre las que se encuentran el certificado de Navegabilidad No.22485, con fecha 14 de febrero de 2022, que se emitió en favor de [Nombre 004], quien resulta, es el propietario registral de la embarcación Dorka II, Matrícula GPC 8821, con números de serie y motor antes reseñados y así consta en la Certificación del Registro Público visible a folios 130 y 131. Don [Nombre 004], no fue tenido como parte formalmente, ni como tercero interesado, ni como tercero civilmente demandado. Tampoco se contempló dentro de los hechos de la acción civil resarcitoria ni en los de la acusación, que el señor [Nombre 004], tuviera algún nivel de conocimiento, directo o eventual e incluso por descuido o negligencia, del que se pudiera derivar que conocía, consentía o toleró la conducta ilícita del acusado, en cuanto a utilizar su embarcación para incursionar en las aguas del área protegida del Parque Nacional Santa Rosa, para realizar faenas de pesca, prohibidas.

El señor [Nombre 004] tiene licencia de pesca, dentro del expediente 504060718 del Instituto Nacional de Pesca y Acuacultura y con vigencia del 9 de julio de 2021 al 13 de agosto de 2024 (original a folio 133). En ese sentido, el propietario se apersonó al proceso a insistir que le fuera devuelta la embarcación o fuere nombrado depositario provisional y en sus peticiones, explicó que no tenía idea de por qué el acusado había realizado ese hecho, que la embarcación se estaba deteriorando y acreditó su condición de propietario legítimo, lo que en este proceso no ha sido desacreditado y el recurso ni siquiera se refiere a ese dato esencial, de enorme relevancia, sobre todo porque se refiere al respeto de un derecho fundamental como es la propiedad, frente a una potestad de imperio del Estado, de hacerse con la propiedad de los bienes, instrumentos o frutos provenientes de un hecho ilícito. De esta forma, cuando el propietario de la embarcación decomisada, se apersonó al proceso, se da por enterado de que ésta ha sido decomisada y hace saber que le pertenece, lo que no significa que se le haya cursado audiencia o se le haya comunicado la posibilidad de que se disponga el comiso de ese bien y de poder defenderse.

Incluso la propia Procuraduría General fue informada de la pretensión del señor [Nombre 004] de pedir la devolución o al menos el depósito provisional, conforme consta a folios 140, lo que fue así ordenado por la autoridad jurisdiccional, que a su vez ordenó la anotación del proceso en el asiento de inscripción de la citada embarcación (folio 137, resolución de las 9:48 horas, del 19 de agosto de 2023) porque era evidente el deterioro que estaba sufriendo ese bien mueble al estar decomisado y sin resguardo y uso. Ciertamente, la lectura de los reclamos permite dar cuenta de que la apelante ni siquiera repara en esos datos esenciales, que se refieren a que la embarcación no pertenecía al acusado, lo que desde luego exigía comprobaciones y actos adicionales que no fueron realizados; segundo, si en cualquier caso, tal petición guardaba alguna relación de proporcionalidad en cuanto al hecho acreditado, el daño ambiental y si podía considerarse en efecto, a la embarcación, como un "instrumento", para cometer el delito, pues la navegación simple, no es por si sola una actividad prohibida en las aguas del Parque Nacional Santa Rosa, sino que lo prohibido es cualquier aprovechamiento de la flora y la fauna lo que incluye la marina y la pesca ilegal.

De modo que, como instrumentos podrían considerarse los utilizados para realizar la pesca ilegítima, en daño al ambiente. Así que, incluso en aplicación de una analogía in bonam partem, de la previsión de ese mismo artículo 110 del Código Penal, se tiene que se excepcionan del comiso, los vehículos automotores, cuando se atribuye la conducta de conducción temeraria, conducta que en sí misma representa un riesgo para la integridad física y la vida de terceras personas, de modo que traslapando esa excepción al caso que nos ocupa, una embarcación, que no es en sí misma un instrumento, sino medio de transporte y podría resultar abiertamente desproporcionado su comiso en casos de pesca ilegal sobre todo a baja escala, como en este caso, lo que no elimina el daño ambiental. Distinto podría ser el caso de embarcaciones que se utilicen para la trata de personas, el tráfico ilícito de migrantes, el trasiego de armas o drogas, pues la relación de los bienes jurídicos y de los riesgos a la vida e integridad de las víctimas justifican el comiso de un instrumento directo del transporte de personas en esas condiciones o de armas o drogas.

No obstante lo dicho, en este caso concreto, resulta que la pretensión del representante estatal es la de que se disponga el comiso de la embarcación, la que, como se indicó, pertenece a una tercera persona. La lectura de la acusación y del libelo de acción civil resarcitoria, como se indicó, no atribuye alguna acción dolosa, negligente o derivada de alguna norma jurídica al propietario de la embarcación, que justificara la pérdida en favor del Estado, de ese bien que le pertenece. Es cierto que en la sentencia no se fundamenta la decisión de devolver la embarcación a quien demuestre ser su legítimo propietario, lo que por cierto ya está demostrado en autos, pero esa insuficiencia afecta al señor [Nombre 004], quien ya ha suficientemente acreditado la titularidad del bien, el cual incluso tiene en su carácter de depositario. Además, tampoco se dispuso la cancelación de la anotación de este proceso, defecto que no perjudica al Estado, sino al propietario.

En tales condiciones, la naturaleza del comiso como una consecuencia civil derivada del delito y su carácter imperativo, no aplican frente a terceros con derechos, como resulta ser este caso y en virtud de ello y en aplicación del numeral 45 de nuestra Carta Magna, junto a la previsión normativa del 110 del Código Penal, procede declarar sin lugar el recurso de apelación interpuesto. Proceda el Tribunal de Flagrancia del Primer Circuito Judicial de Liberia a cancelar la anotación en el asiento de inscripción de la embarcación Dorka II, matrícula [Valor 003], motor marca Yamaha F75CEDL, número 68C1001884, inscrita a nombre de [Nombre 004] y a realizar las diligencias necesarias para la devolución a su propietario.

POR TANTO:

Se declara sin lugar el recurso de apelación de sentencia interpuesto por la Procuraduría General de la República. Proceda el Tribunal de Flagrancia del Primer Circuito Judicial de Liberia a cancelar la anotación en el asiento de inscripción de la embarcación Dorka II, matrícula [Valor 003], motor marca Yamaha F75CEDL, número 68C1001884, inscrita a nombre de [Nombre 004] y a realizar las diligencias necesarias para la devolución a su propietario. NOTIFÍQUESE.- Helena Ulloa Ramírez Jorge A.
