THE STATE DEFENDANT:

[Nombre 001] No. N° 2023004470 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, at ten hours and two minutes on dieciocho de Octubre del dos mil ventitres.- The Court rules, on its own motion, on the joinder of necessary active co-parties (integración del litisconsorcio activo necesario) in the ordinary proceeding brought by THE STATE against [Nombre 001] AND THE ESTATE OF [Nombre 002].- BACKGROUND

  1. 1By the initial complaint filed on 07 de mayo de 2021, the plaintiff appeared before this Court and requested that the judgment declare: “(...) 1. Declare that the unregistered lands (terrenos sin inscribir) described in cadastral plans (planos catastrados) N° H-406207-97 and N° H-392378-97 are public-domain property (bienes de dominio público) and form part of the State Natural Heritage (Patrimonio Natural del Estado), where the powers of administrative self-enforcement over public-domain property (potestades de autotutela demanial administrativa) shall apply because they constitute part of the northern border strip and, at the same time, protected wildlife areas (áreas silvestres protegidas). //2) By virtue of the declaration requested in the first prayer for relief (extremo petitorio), order the cancellation of plans H-406207-97 and N° H-392378-97 in the Catastro Nacional. //3) Because they are in the public domain, the lands identified in the first prayer may not be acquired by private parties under any title, whether inter vivos or mortis causa. //4) Order [Nombre 001] to pay for the environmental damage (daños ambientales) caused on the lands at issue in this litigation. // 3) In the event of opposition, both categories of costs (ambas costas) and interest thereon shall be imposed upon the defendant.” (see images 14 and 15 of the digital case file); likewise, by a filing dated 08 de octubre de 2021, appearing at image 27 of the digital case file, the State expanded claim number 4 so that it would read as follows: “4) Order [Nombre 001] to pay for the environmental damage caused on the lands at issue in this litigation, as established in report SINAC-ACTo-DRFVS-O-146-2021 of 26 de agosto de 2021.”.
  2. 2By an order issued at ten hours and eighteen minutes on diecisiete de agosto de dos mil veintiuno, the ordinary proceeding brought by THE STATE against [Nombre 001] AND THE ESTATE OF [Nombre 002] was deemed commenced (see image 21 of the digital case file), and the defendants were granted a period in which to answer; likewise, by an order issued at ten hours and twenty-one minutes on trece de enero de dos mil veintidós, the expansion thereof was accepted, and the defendants were granted a period in which to answer that expansion (see image 150 of the digital case file).
  3. 3By an order issued at eleven hours and forty-five minutes on veintisiete de octubre de dos mil veintidós, appearing at image 191 of the digital case file, the parties were granted a hearing (audiencia) for a period of three business days regarding the possible joinder of the Sistema Nacional de Áreas de Conservación (SINAC) as a party to the litigation (necessary active joinder), pursuant to ruling 191-F-S1-2022 of the Sala Primera de la Corte Suprema de Justicia.
  4. 4In response to the hearing granted by the order identified in the preceding paragraph, counsel for co-defendant [Nombre 001] stated that it agreed with joining SINAC to the litigation as a necessary passive co-party (see image 195 of the digital case file); counsel for the other co-defendant (Estate of [Nombre 002], see images 196 to 200 of the digital case file), however, opposed joining SINAC to the litigation, stating, in summary, that judgments issued in case file 02-160268-0507-CI had been attached when the complaint was answered and that those judgments showed that the property belongs to the estate; it therefore opposed joinder for the reasons stated. Finally, counsel for the State, as plaintiff in this proceeding, addressed the hearing in a filing appearing at images 204 to 206 of the digital case file. In summary, the State opposed the estate’s statements concerning the lawsuit identified by that party and stated the following regarding joinder: “(...) We consider it appropriate and necessary to join the Sistema Nacional de Areas de Conservación to the litigation because that System is responsible for administering the northern border strip, as well as the Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte.As we have stated, by their nature, the lands in dispute constitute public-domain assets (bienes demaniales) belonging to the Patrimonio Natural del Estado, over which SINAC has jurisdiction. Accordingly, and to avoid future nullities (nulidades), it is appropriate to join this body to the litigation.” (see image 204 of the digital case file).
  5. 5The requisite procedural rules have been followed in these proceedings, and no grounds for nullity are apparent.-

CONSIDERATIONS

I. THE PARTIES’ ARGUMENTS

As set forth above, in response to the hearing granted by the order issued at eleven hours and forty-five minutes on veintisiete de octubre de dos mil veintidós, appearing at image 191 of the digital case file, counsel for co-defendant [Nombre 001] stated that it agreed with joining SINAC to the litigation as a necessary passive co-party (see image 195 of the digital case file); counsel for the other co-defendant (Estate of [Nombre 002], see images 196 to 200 of the digital case file), however, opposed joining SINAC to the litigation, stating, in summary, that judgments issued in case file 02-160268-0507-CI had been attached when the complaint was answered and that those judgments showed that the property belongs to the estate; it therefore opposed joinder for the reasons stated. Finally, counsel for the State as plaintiff addressed the hearing in a filing appearing at images 204 to 206 of the digital case file.

In summary, the State opposed the estate’s statements concerning the lawsuit identified by that party and stated the following regarding joinder: “(...) We consider it appropriate and necessary to join the Sistema Nacional de Areas de Conservación to the litigation because that System is responsible for administering the northern border strip, as well as the Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte. As we have stated, by their nature, the lands in dispute constitute public-domain assets belonging to the Patrimonio Natural del Estado, over which SINAC has jurisdiction. Accordingly, and to avoid future nullities, it is appropriate to join this body to the litigation.” (see image 204 of the digital case file).

II.ON THE STATE NATURAL HERITAGE (Patrimonio Natural del Estado): With respect to the present proceeding, the so-called “theory of the case” advanced by the State’s representatives is that the properties identified in the relief sought in their complaint form an integral part of the State Natural Heritage (Patrimonio Natural del Estado, PNE), where the powers of administrative self-protection over public-domain property (potestades de autotutela demanial) apply, because they constitute both the northern border strip and protected wild areas (áreas silvestres protegidas), including even “wetland” (humedal) areas (see the section concerning the relief sought in the proceeding, as well as section 5 of the complaint regarding “environmental damage” (daños ambientales)). Now then, regarding the regime governing the State Natural Heritage, which forms part of the “theory of the case” advanced by the State’s representatives, this Court has stated, to cite only one precedent, in judgment N°50-2022-IX, issued at eight twenty-five a.m. on November tenth, two thousand twenty-two, insofar as relevant, as follows: “(...) IN GENERAL REGARDING THE STATE NATURAL HERITAGE: It bears recalling that the fundamental right to a healthy and ecologically balanced environment was recognized and protected as such in our country even before the amendment of Article 50 of the Political Constitution, by Ley Forestal N° 4465 of November 25, 1969—repealed by Ley Forestal N° 7575 of February 5, 1996—which not only established ‘...as an essential function and priority of the State, ensuring the protection, conservation, use, industrialization, administration, and promotion of the country’s forest resources, in accordance with the principle of rational use of renewable natural resources...’ (Article 1), but also the concepts of Forest (Bosque) (Article 6) and State Forest Heritage (Patrimonio Forestal del Estado) (Article 32, first paragraph).

With regard to the State Forest Heritage, Ley Forestal N° 4465 established its characteristics (Article 33); the bodies competent to administer and oversee the State Forest Heritage, which under that legislation were the Dirección General Forestal and the Ministerio de Ambiente y Energía (Article 32, second paragraph); and the powers conferred upon those bodies to protect and conserve the State Forest Heritage, among which the following are notable: actions to recover possession of those properties (acciones reivindicatorias) (Article 33); the establishment, within the State Natural Heritage, of forest reserves (reservas forestales), protection zones (zonas protectoras), national parks (parques nacionales), national wildlife refuges (refugios nacionales de vida silvestre), and biological reserves (reservas biológicas) (Articles 35 through 37); and the demarcation (deslinde), on the relevant lands, of the areas comprising the State Forest Heritage (Article 38).

Ley Forestal number 7575 of February 5, 1996, which currently governs us, in turn adopts that concept but changes its name, as it is now called the State Natural Heritage, a broader term encompassing the protection and preservation of the forest ecosystem (ecosistema boscoso) (Article 3(c) of Ley Forestal). The State Natural Heritage is part of the public domain (dominio público); consequently, the lands and forests included within it are immune from attachment (inembargables), not subject to acquisition by prescription (imprescriptibles), and inalienable (inalienables), while their conservation and administration are entrusted by law to the Ministerio de Ambiente y Energía, through the Sistema Nacional de Áreas de Conservación (Articles 6(a), 13, second paragraph, and 14 of Ley Forestal; Article 32, second paragraph, of Ley Orgánica del Ambiente). Moreover, it consists of two important components: 1) Protected Wild Areas, regardless of their management category (categoría de manejo), that have been declared by statute or Executive Decree, namely: forest reserves, protection zones, national parks, biological reserves, national wildlife refuges, wetlands, and natural monuments (Ley Forestal 7575, Article 1°, paragraphs 2° and 3°, subsection i; Ley Orgánica del Ambiente N° 7554, Article 32; Ley de Biodiversidad N° 7788, Articles 22 et seq. and 58; Ley del Servicio de Parques Nacionales N° 6084, Article 3°, subsections d and f, in relation to Ley Orgánica del MINAE N° 7152 and its Regulations; Ley de Conservación de la Vida Silvestre N° 7317, section 82(a)); and 2) all other forests and forest lands (terrenos forestales) within inalienable areas, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, which are immediately subject to a statutory designation (afectación legal inmediata) (Article 13, first paragraph, of Ley Forestal) / [in this regard, judgment number 2008-16975, issued by the Sala Constitucional de la Corte Suprema de Justicia at 14:53 on November 12, 2008, may be consulted].

In addition, the Sala Primera de la Corte Suprema de Justicia has stated on this matter that: ‘(...) Pursuant to section 13 of Ley Forestal, “The State Natural Heritage shall consist of the forests and forest lands of national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets...” Thus, the provision establishes three possible categories of property comprising that heritage: a) forests and forest lands of national reserves; b) forests and forest lands of areas declared inalienable; and c) forests and forest lands of properties registered in its name and those belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets.

Accordingly, the position expressed by the IDA—that the property at issue in this proceeding cannot be considered part of the State Natural Heritage because it is not located within a national reserve, protected wild area, forest reserve, or biological reserve—arises from an improper interpretation of the cited section. In this regard, the mandate in section 13 ibid. is clear in determining that forest-covered property belonging to the State, a municipality, an autonomous institution, or another Public Administration body forms part of the State Natural Heritage, without the Legislature requiring that the property belong to any of the indicated protection categories.’ (In this regard, judgments numbers 1070, issued at 9:45 a.m. on September 03, 2010, and 1088, issued at 8:55 a.m. on September 8, 2010, may be consulted).” Regarding SINAC, the Court has also stated that it is a body possessing instrumental legal personality (personalidad jurídica instrumental) (see, among others, judgment N° 62-2022, issued at one forty p.m. on January seventeenth, two thousand twenty-two, as well as judgment N° 247-2016-T, issued at three eighteen p.m. on February fourth, two thousand sixteen, among many others).

III. ON NECESSARY JOINDER (LITISCONSORCIO NECESARIO)

Article 71 of the Administrative Litigation Procedural Code (Código Procesal Contencioso Administrativo, CPCA) provides that necessary joinder shall be ordered by the court on its own motion or at the request of a party at any time before judgment is rendered. An essential aspect of judicial proceedings concerns identifying the parties who must participate therein, which is determined on the basis of the legal-administrative relationship underlying the dispute, so that the Court may issue a ruling on the merits that produces effects among the appropriate parties, since it is not possible to render a judgment on the merits by dividing the substantive legal relationships or assessing them solely with respect to some of their parties, as the decision must encompass and bind all parties to that relationship. Regarding the necessary inclusion of defendants through joinder (litisconsorcio pasivo), this Court stated, among other decisions, in ruling N°1012-2021-T at diez horas cincuenta y cinco minutos del treinta de julio de dos mil veintiuno, as follows: “The First Chamber of the Supreme Court of Justice (Sala Primera de la Corte Suprema de Justicia), acting as the Court of Cassation for Administrative Litigation (Tribunal de Casación de lo Contencioso-Administrativo), has addressed this issue on several occasions, holding that this doctrine entails the existence of substantive legal relationships concerning which it is not possible to rule by dividing them or assessing them solely with respect to some of their parties, because the decision encompasses and binds them all.

The presence of all parties is essential for the procedural relationship to be complete and for a judgment on its merits to be possible (Resolution number 156-F-TC-2008, de 8:45 horas del 7 de noviembre, citing resolutions numbers 824-2000 de las 16 horas 05 minutos del primero de noviembre de 2000 and 482-2005 de las 10 horas 30 minutos del 07 de julio de 2005). The Chamber has further stated that this doctrine seeks to guarantee participation and a defense in the proceedings for all parties whose substantive legal sphere will be affected by the final resolution of the matter, either because the claim must be brought by a group of parties holding the subjective interest whose protection or recognition is sought (necessary joinder of plaintiffs (litisconsorcio activo necesario)), or because it must necessarily be brought against them (necessary joinder of defendants (litisconsorcio pasivo necesario)).

With respect to the necessary joinder of defendants, the First Chamber has further stated that this doctrine seeks to ensure the proper formation of the adversarial proceedings, because, given the indivisible nature of the substantive relationship, it is essential, as regards the defendant side, that all parties responsible for opposing the asserted claim participate in the proceedings. Hence the importance of properly establishing joinder, since otherwise the merits of the matter cannot be heard and the judgment cannot rule on the substantive legal situation disputed in the proceedings, because it cannot affect or prejudice anyone who was not a party with the requisite observance of due process (Resolution Nº 156-F-TC- 2008, de las 8:45 horas del 7 de noviembre, citing resolutions numbers 29-F-TC-2008 de las 14:15 horas del 8 de mayo de 2008, 30-F-TC-2008 de las 14:20 del 8 de mayo de 2008 and Nº 63-A-TC-2008 de las 9:45 horas del 11 de junio del 2008).

In other words, joinder will be necessary when the legal relationship involves a party who is not present in the proceedings.- In this case, the procedural requirements must be assessed to determine whether the parties should be joined: on the one hand, whether joinder is required by a legal mandate under which the participation of all parties is prescribed by the legal system itself.- And, on the other hand, whether the claims are directed against other parties and/or the underlying legal relationships require their inclusion before judgment may be rendered, in order to safeguard due process and the right of defense and to prevent a denial of the right to be heard that could result in the possible nullity of the proceedings.-” (emphasis added). Accordingly, it is essential, as regards the defendant side, that all parties responsible for opposing the asserted claim participate in the proceedings; otherwise, the merits of the matter cannot be heard and the judgment cannot rule on the substantive legal situation disputed in the proceedings, because it cannot affect or prejudice anyone who was not a party with the requisite observance of due process. Likewise, in cases similar to the one addressed in this expediente, the Administrative Litigation Court (Tribunal Contencioso Administrativo), through resolution N° 349-2021 de las quince horas cero minutos del diecisésis de marzo de dos mil veintiuno, stated the following regarding the doctrine at issue: “The Sala Primera de la Corte Suprema de Justicia, acting as the Tribunal de Casación de lo Contencioso Administrativo, has held in its case law that joinder, in either of its forms, whether involving plaintiffs or defendants, constitutes a guarantee of participation and defense for all parties whose sphere of rights may be affected by the decision on the merits in a particular case. It is therefore a means of safeguarding the adversarial process so as to ensure the participation of all parties responsible for opposing the claim, since granting it in one manner or another may prejudice their rights or legitimate interests.

(In this regard, see decisions 824-2000 del 01de noviembre del 2000; 9-F-TC-2008 del 8 de mayo de 2008; 30-F-TC- 2008 del 8 de mayo de 2008; 63-A-TC-2008 del 11 de junio de 2008, all cited in resolution 185-2009 del 27 de agosto del año 2009 of the Tribunal de Casación Contencioso Administrativo y Civil de Hacienda). Similarly, the Administrative Litigation Court of Appeals (Tribunal de Apelaciones de lo Contencioso Administrativo), insofar as relevant to this particular case, has held: ‘For these purposes, it must therefore be reasoned that the person must be present in judicial proceedings whose resolution directly affects that person, particularly under the principle of effectiveness of the resolution rendered, since a person cannot be affected by the decision without having had the opportunity to be a party and present whatever arguments that person deems relevant in defense of that person’s legal position.

The opposite would create a state of procedural defenselessness that would render the proceedings null and would also prevent enforcement of any judgment contrary to the position that the representation of that entity might hold.’ (See decision 638 del 30 de noviembre del 2010). Thus, Article 71 of the Código Procesal Contencioso Administrativo provides that necessary joinder shall be ordered by the court on its own motion or at the request of a party at any time before judgment is rendered. With respect to the parties who must be summoned to appear in administrative litigation proceedings, Article 12 of that body of law states: ‘ARTICLE 12.- The following shall be deemed defendants:

  • 1)The Public Administration (Administración Pública) that issued the administrative conduct at issue in the proceedings, except in cases involving the Executive, Legislative, or Judicial Branches or the Supreme Electoral Tribunal (Tribunal Supremo de Elecciones), in which case the State shall be sued.
  • 2)Administrative bodies possessing instrumental legal personality, insofar as they issued the administrative conduct at issue in the proceedings, jointly with the State or the entity to which they are attached.
  • 3)Natural or legal persons who have derived rights and legitimate interests from the administrative conduct at issue in the proceedings.
  • 4)Any other person who has been summoned to the proceedings as a responsible party in a functional or personal capacity.
  • 5)The Office of the Comptroller General of the Republic (Contraloría General de la República): a) Jointly with the State, when the proceedings concern its administrative conduct relating to the exercise of its constitutional and statutory authority. b) Jointly with the audited entity, when the proceedings concern administrative conduct subject to its oversight in the exercise of its powers of auditing or higher supervision of the Public Treasury (Hacienda Pública).
  • 6)When an entity issues an act or provision that, to become final, requires prior review, authorization, approval, or acknowledgment by a State body or another administrative entity, the following shall be deemed a defendant: a) The State or entity that issued the reviewed act or provision, if the outcome of the review was approval. b) The entity that conducted the review, if it did not approve the act or provision.
  • 7)When an entity issues an act or provision that, by virtue of a nonhierarchical administrative appeal—optional or mandatory—must be heard by a State body or another administrative entity, the following shall be deemed a defendant: a) The State or entity that issued the act, when it has been upheld. b) The entity that, upon hearing the appeal, annuls, revokes, or modifies the challenged conduct.
  • 8)If the plaintiff bases the claims on the unlawfulness of a general provision, the Administration that issued it shall also be deemed a defendant, even if the challenged action did not originate from it..’ The preceding subsections describe circumstances in which joinder is necessary; additionally, necessary joinder must be considered when, due to the nature of the substantive legal relationship involved in the proceedings, the decision must be made with the participation of several persons who must be sued. It must therefore be determined whether the foregoing applies to the present case.// (...) For purposes of analyzing this matter, it is necessary to consider the facts and claims set forth in the complaint, the parties’ arguments, and the evidence submitted in the record; having noted the foregoing, the corresponding analysis will now be undertaken. a) Regarding the arguments for joining the State and the Instituto Costarricense de Turismo as parties to the dispute, this Judge considers their participation necessary in order to resolve the conflict, because the relief sought is not limited to determining the existence of strict liability (responsabilidad objetiva) on the part of the municipal entity; rather, the dispute arises from the possible overlap between the concession area (maritime-terrestrial zone (zona marítimo terrestre)) and privately owned property belonging to (...). In this regard, it should be emphasized that although the plaintiff asserts no claims against the State or the Instituto Costarricense de Turismo, the conduct at issue in the proceedings was not adopted by them, and they are not being required to take any action, either directly or indirectly, the fact remains that what is disputed in this case is a possible overlap of the maritime-terrestrial zone with private property, and the nullity of concession number (...) granted by the Municipalidad de Garabito in favor of Mr. (...), registered under the real-property folio registration (matrícula de folio real) of the Partido de Puntarenas, (...), is sought. Thus, it is clear that the subject matter of the proceedings is directly related to the area of the maritime-terrestrial zone and, pursuant to numeral 1 of Ley No. 6043, “The maritime-terrestrial zone forms part of the national patrimony, belongs to the State, and is inalienable and not subject to acquisition by prescription.

Its protection, as well as that of its natural resources, is an obligation of the State, its institutions, and all inhabitants of the country. Its use and exploitation are subject to the provisions of this law.” The foregoing means that, although municipal entities hold the usufruct and administer the maritime-terrestrial zone (art. 3 ibíd.), that zone belongs to the State; indeed, Article 4 of the same Law provides that: “The Office of the Attorney General of the Republic, on its own initiative or at the request of any State entity or institution or interested party, shall exercise legal oversight to ensure due compliance with the provisions of this law. Consequently, it shall take the appropriate steps with respect to any actions that violate or tend to infringe these provisions or those of related laws, that seek to obtain rights or recognition thereof contrary to those rules, or to annul concessions, permits, contracts, acts, agreements, or provisions obtained in contravention thereof.” This provision is particularly relevant, since the proceeding seeks the annulment of a concession right (claim No. 4 against the Municipalidad de Garabito); likewise, Article 2 of the same Law provides: “The Instituto Costarricense de Turismo, on behalf of the State, is responsible for the overarching and general supervision of all matters relating to the maritime-terrestrial zone.” As can be seen, insofar as the dispute seeks the acquisition, recognition, or annulment of rights over areas within the maritime-terrestrial zone, it is prudent and consistent with due process, in order to prevent future nullities, to join the State and the Instituto Costarricense de Turismo in these proceedings.

Accordingly, the preliminary defense of failure to join necessary parties on the defendant’s side is upheld, and the STATE and the INSTITUTO COSTARRICENSE DE TURISMO are therefore ordered joined as necessary co-defendants (litisconsortes pasivos). The claimant is directed, within three business days, to provide a complete physical or digital copy of these proceedings for the purpose of serving notice upon the joined parties.” (emphasis added). Accordingly, under the precedents cited above, this procedural mechanism seeks to guarantee participation and a defense in the proceeding to all parties whose substantive legal sphere will be affected by the final decision in the matter, either because the claim must be brought by multiple parties who hold the subjective interest for which protection or recognition is sought—necessary joinder of plaintiffs (litis consorcio activo necesario)—or because the claim must necessarily be brought against them—necessary joinder of defendants (litis consorcio pasivo necesario).

The doctrine of necessary joinder of plaintiffs is governed by section 22.1 of the current Código Procesal Civil, which applies to this matter pursuant to Article 220 of the Código Procesal Contencioso Administrativo (CPCA), and, as relevant here, provides: “22.1 Necessary joinder (Litisconsorcio necesario). When, by operation of law or because of the nature of the substantive legal relationship, the decision must involve several persons, they must sue or be sued in the same proceeding (...).” It is therefore evident from the precedents of this Tribunal cited above, as will be discussed in detail below, that insofar as the dispute seeks the acquisition, recognition, modification, or annulment of rights over areas alleged to form part of the State Natural Heritage (Patrimonio Natural del Estado), and insofar as this action seeks a declaration that they comprise the northern border strip and protected wild areas (áreas silvestres protegidas), it is prudent and consistent with due process, in order to prevent future nullities, to join SINAC in the dispute, in this case through necessary joinder of plaintiffs, as explained below.

IV. REGARDING THE SPECIFIC CASE

For the analysis of this matter, it is necessary to take into consideration the facts and claims set forth in the complaint, the parties’ arguments, and the evidence submitted in the record; having noted the foregoing, the corresponding analysis will be conducted. This Administrative and Civil Tax Court, taking into consideration the legal nature of SINAC as a body with instrumental legal personality (órgano con personalidad jurídica instrumental), ordered that it be joined in the following terms: “SOLE MATTER: NECESSARY PASSIVE JOINDER IN THE SPECIFIC CASE: Necessary passive joinder (litisconsorcio pasivo necesario) presupposes that, in order to resolve the matter, all persons whose interests or rights may be affected by the ruling must be present in the proceedings. In other words, this doctrine makes it impossible to validly constitute proceedings and issue a judgment without the presence and effective participation of each and every person involved in the substantive legal relationship or whose presence is required by law, so that they may exercise their right of defense.

Having analyzed both the application for interim relief (medida cautelar) and the State’s response, in which the State indicates that it is necessary to join the Sistema Nacional de Áreas de Conservación (SINAC) as a party to these proceedings because it is a body with instrumental legal personality of the Ministerio de Ambiente y Energía, it is determined that SINAC must be joined as a defendant, pursuant to subsection 2) of article 12 of the Código Procesal Contencioso Administrativo, because, by operation of law, this dispute cannot be validly resolved without its participation. Consequently, it is ordered that the Sistema Nacional de Áreas de Conservación be joined as a necessary passive co-litigant (litis consorte pasivo) in these proceedings. Accordingly, before serving the application for interim relief on that body, and with notice that future filings will otherwise not be considered, the moving party is directed to submit, within three days, a complete set of copies of all proceedings conducted to date.” (Tribunal Contencioso Administrativo y Civil de Hacienda, N° 247-2016-T de las quince horas y dieciocho minutos del día cuatro de febrero de dos mil dieciséis, emphasis added).

In this case, both parties agree that the subject matter of the proceedings is directly related to a requested declaration concerning an area described in plans N° H-406207-97 and N° H-392378-97, which the State’s representative, as plaintiff, identifies as forming part of the State Natural Heritage (Patrimonio Natural del Estado), because it is part of the northern border strip (franja fronteriza norte) and, at the same time, of protected wildlife areas (áreas silvestres protegidas). In cases similar to the present one, in which claims comparable to those at issue here have been asserted, it has been ordered that SINAC’s representative be joined in the litigation. In this regard, reference may be made, among others, to this Court’s ruling of las quince horas cuarenta minutos del primero de febrero de dos mil diecinueve (issued in expediente 16-000033-0387-AG), which also ordered SINAC’s joinder in the following terms: “III.

REGARDING THE SPECIFIC CASE: Analysis of the specific case shows that the plaintiff raises a dispute concerning the possible overlap between the properties registered in Guanacaste under numbers [Valor 001], [Valor 002] and [Valor 003], which it owns, and properties [Valor 004] and [Valor 005], whose owners are, respectively, [Nombre 004] and [Nombre 005]. In this regard, in its ruling of las catorce horas del del 8 de marzo de 2017, issued in administrative expediente 2015-1598-RIM, the Registro Público Inmobiliario states that ‘...properties [Valor 006] and 038779 originated from the opening of the registry entries following the respective possessory-information proceedings (diligencias de información posesoria), which occurred on 01 de marzo del año 1977. At that time, Ley No. 2825 (del 14 de octubre de 1961) was already in force and designated as inalienable and not subject to acquisition by prescription (imprescriptibles) those lands located within the two kilometers closest to the Border with Nicaragua (...) Decreto No.22962 MIRENEM declared that area the Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte (...)’—the ruling continues in point Six—‘Consequently, and in accordance with the overlaps identified by the Departamento Catastral Técnico, which encompass not only lands belonging to other private parties but also lands located within the inalienable zone, because they are borderlands and environmental protection zones...’ (images 520 to 549 of the digital case file).

The quoted passage indicates that (sic) that the properties at issue could be located within the Franja Fronteriza Norte and that, pursuant to Decreto No.22962 MIRENEM, that area was declared the Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte. In this regard, article 1 of that decree provides: ‘The border corridor consisting of the lands within a 2 000 m-wide zone along the border with Nicaragua, from Punta Castilla on the Mar Caribe to Bahía Salinas on the Océano Pacífico, as established in the Tratado Cañas-Jerez del 15 de abril de 1858, is hereby declared a National Wildlife Refuge.’ Now then, pursuant to articles 13 of the Ley Forestal and 22 of the Ley de Biodiversidad, the Sistema Nacional de Áreas de Conservación is responsible for the administration and defense of the State’s natural heritage. Therefore, considering the declaration of the border corridor as a Refugio Nacional de Vida Silvestre—within which, as already indicated, the properties at issue in these proceedings are located—this Judge can conclude that a potential judgment granting relief could directly and immediately affect the State’s natural heritage and requires the full and necessary participation of the responsible body, namely the Sistema Nacional de Áreas de Conservación (SINAC), because the substantive legal relationship directly involves that body’s authority.

Accordingly, pursuant to article 22.1. of the Código Procesal Civil and article 220 of the Código Procesal Contencioso Administrativo, it is ordered that the Sistema Nacional de Áreas de Conservación be joined as a necessary passive co-litigant.” (emphasis added). In this case, the first claim asserted by the State’s representative concerns a potential declaration regarding the properties at issue, seeking a declaration that they are public-domain property (bienes de dominio público) subject to the powers of administrative self-enforcement over public-domain property (potestades de autotela demanial), because they form part of the northern border strip and protected wildlife areas. The issue in this case is therefore whether those properties may be located within the Franja Fronteriza Norte; in this regard, pursuant to Decreto No.22962 MIRENEM, that area was declared the Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte.

Thus, a potential judgment granting relief could directly and immediately affect the State’s natural heritage, requiring the full and necessary joinder of the responsible body, namely the Sistema Nacional de Áreas de Conservación (SINAC). It would then remain to determine the capacity in which SINAC should participate because, unlike in the precedent cited above, the State is the plaintiff in this case and is the party seeking the aforementioned declaration concerning the public-domain status (demanialidad) of the properties. In a case similar to the present one, the higher court with jurisdiction over the subject matter, the Sala Primera de la Corte Suprema de Justicia, by ruling 000191-F-S1-2022 de las nueve horas cuatro minutos del tres de febrero de dos mil veintidós, ordered SINAC’s joinder, even at the cassation stage (sede de casación), and, given the absence of the State and SINAC from a necessary active joinder (litis consorcio activo necesario), it even ordered that the case be remanded to the Court so that it could proceed as required by law, joining SINAC and the State as necessary active co-litigants.

In summary, the higher court ordered the foregoing in the following terms: “(...) there is an underlying aspect of paramount importance—which therefore cannot be disregarded when resolving the dispute—namely, that public-domain property is at issue, involving environmental protection (provision 50 of the Constitución Política) and belonging to the State’s natural heritage (PNE), and therefore affecting the public interest. Moreover, the Court itself quoted part of a ruling by the Sala Constitucional, which held that ‘…domestic legislation implements that commitment through certain statutes, such as the Ley Orgánica del Ambiente, ley Nº 7554 de 28 de setiembre de 1995, which, in article 32, included Wetlands among the various management categories (categorías de manejo) of protected wildlife areas, which are administered by the Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET)—with the cooperation of the municipalities—and declared them, as well as their conservation, to be matters of public interest.

Regarding the “Convención relativa a los Humedales de Importancia Internacional especialmente como Hábitat de aves acuáticas, o Convención de Ramsar,” Costa Rica has entered into numerous international instruments protecting our ecological wealth which, under domestic law, constitute fully applicable legislation—and are directly judicially enforceable. It therefore decided that it was unconstitutional to require that the designation of a wetland and its area of influence as protected areas be made by Executive Decree; only the requirements established in the Ley Orgánica del Ambiente need be followed, for which purpose the State is empowered to expropriate or cancel private landholdings. It emphasized, however, that this did not entail denying the existence and protection of wetland ecosystems merely because they had not been declared protected wildlife areas or were located on private property.

At the international level, the Constitutional Court emphasized that the Convención Ramsar was ratified by the Asamblea Legislativa through Ley no. 7224 del 9 de abril de 1991, article one of which establishes the international importance and protection of wetlands. It added: “IV.- Regarding wetlands and their environmental, cultural, and economic importance. This Chamber has addressed the importance and protection of these ecosystems in judgments 2001-12817 de las 10:28 horas del 14 de diciembre del 2001 and 2007-6246 de las 19:30 horas del 8 de mayo del 2007, among others, noting that wetlands are regarded as some of the world’s most productive ecosystems. In the Convención de Ramsar, signed on 2 de febrero de 1971, a wetland is defined as: ‘Areas of marsh, fen, peatland, or water, whether natural or artificial, permanent or temporary, with water that is static or flowing, fresh, brackish, or salt, including areas of marine water whose depth at low tide does not exceed six meters.’ In Costa Rica, article 40 of the Ley Orgánica del Ambiente defines them as: ‘Ecosystems dependent on natural or artificial, permanent or temporary, lentic or lotic, fresh, brackish, or saltwater regimes, including marine areas extending to the outer limit of seagrasses or reefs or, in their absence, to a depth of six meters at low tide.’ The importance of wetlands derives not only from their biodiversity and the processes occurring within them on an ecological scale, but also from the fact that they provide supporting functions and essential products for human communities throughout the developing and industrialized world… They also possess highly valuable attributes, such as biological diversity and the uniqueness of cultural heritage.

It is the combination of these ecosystem functions, products, and attributes that makes wetlands important to society… the Ley Orgánica del Ambiente, ley Nº 7554 de 28 de setiembre de 1995… in Article 32, included wetlands among the various management categories of protected wilderness areas (áreas silvestres protegidas), which are administered by the Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET)—with the collaboration of the municipalities—and declared them, as well as their conservation, to be in the public interest.” At this point, reference must be made to what this adjudicatory body has stated regarding standing (legitimación), namely, that it is a substantive prerequisite of every procedural relationship (relación procesal), necessary for the admissibility of the substantive claim; that is, a party has standing when it alleges a specific legal relationship with the relief sought in the dispute.

Thus, it is the capacity to be a party in a specific proceeding and may be active or passive, depending on the conditions established by law for that purpose in relation to the procedural claim. Accordingly, active standing to sue (legitimación ad causam activa), which is relevant here, is the capacity to bring an action, a status arising from the position of the subject with respect to the procedural claim asserted and pertaining to the person who, under the law, may assert the claims set forth in the complaint. In short, it is the necessary identity that must exist between the plaintiff and the right claimed in court. It is therefore standing to obtain a judgment on the merits. It pertains to the plaintiff and to persons who subsequently intervene to defend the plaintiff’s cause. Its absence constitutes a substantive impediment; if the judge becomes aware of that absence, the judge must declare it, even sua sponte, and issue a judgment declining to rule on the merits (sentencia inhibitoria).

In this regard, during the proceedings and insofar as relevant, Municipalidad de Belén requested joinder of the State in the litigation (integración de la litis). In resolution no. 938-2013, issued at 15 hours 30 minutes on 13 de mayo de 2013, the case-management judge denied that request and instead ordered that the Procuraduría General de la República be notified as an interested third party, in which capacity it participated. As stated, the subject matter of the proceedings involves a fundamental issue: the protection of a wetland—which is an integral part of the State’s Natural Heritage (patrimonio natural del Estado)—and an asset in the public domain (bien de dominio público). Consequently, it is clear that, in its analysis, the Tribunal overlooked the fact that the protection of a wetland was at stake—a wetland that has the corresponding official designation, as explained supra—that forms part of the State’s Natural Heritage and is an asset in the public domain, the administration of which falls within the jurisdiction of MINAE through SINAC (judgments of this Chamber numbers 1239, issued at 11 hours 50 minutes on 31 de marzo de 2020, and 19776-2014, issued at 10 hours 30 minutes on 3 de diciembre de 2014).

Accordingly, this Chamber finds that the State and SINAC should have been joined in the litigation in order to complete the joinder of plaintiffs (litis consorcio activo), which was incomplete. This is pursuant to section 106 of the repealed Código Procesal Civil, which must be applied here because of the reference made by section 220 of the CPCA and because it was in force when the present case was initiated; it requires joinder in the litigation, whether by operation of law or because of the nature of the substantive legal relationship—as in this case—since the ruling affects those participants, who, due to the nature of the asset (a wetland forming part of the PNE), must participate as co-plaintiffs. It should be added that only in this manner can the dispute be resolved because, as indicated, SINAC is responsible for determining the extent of the wetland, as well as the setback (retiro) applicable to urban development works or works of any kind that may adversely affect the protected ecosystem. // IV.- Under these circumstances, the appropriate course is to order sua sponte that the State and SINAC be joined in the proceedings as co-plaintiffs, since both entities have a clear ex lege responsibility for the management and oversight of areas forming part of the PNE.

Their participation is therefore indispensable because they are parties to the legal relationships on which the judgment must rule. Accordingly, the judgment issued in these proceedings shall be vacated, and the case file shall be remanded to the Tribunal for further proceedings in accordance with law, joining the State and SINAC as necessary co-plaintiffs (litis consorcio activo necesario). // (...) // THEREFORE // The challenged decision is vacated. The case is remanded to the Tribunal for further proceedings in accordance with law, joining SINAC and the State as necessary co-plaintiffs. By majority vote, the evidence already taken that is useful and necessary to resolve the dispute is preserved. Judges Rivas Loáiciga and López Casal dissent.” (emphasis added). In the specific case, the foregoing reasoning of the Sala Primera de la Corte Suprema de Justicia applies to the matter before us; therefore, this judge finds that SINAC must be joined in the litigation to complete the joinder of plaintiffs, which is incomplete.

This is because the ruling in this case affects those participants (State–SINAC), who, due to the nature of the property (which is alleged to include a wetland and areas forming part of the PNE), must participate as co-plaintiffs. It should be noted that the complaint filed by the State’s counsel even indicates that “wetlands” are located in the area, as in the precedent of the Sala Primera cited above, with the State’s counsel stating the following in its complaint: “According to official letter SINAC-ATCTO-DIR-137-2021 (which is offered as evidence), within the lands described in survey plan H-392378-97 there are wetlands recorded in inventory FID 2321, known as San Luis 2, comprising 257,2 hectares of the palustrine emergent marsh type, and FID 2318, known as Palustre San Luis 3, comprising 3,627.1 hectares of the palustrine cativo and yolillo swamp type. (...) Wetlands are protected under our legal system by the Ley Orgánica del Abmiente, Articles 32 f), art. 40, 41, and 45.

The latter prohibits activities aimed at interrupting the natural cycles of wetland ecosystems, such as the construction of dikes that prevent the flow of marine or inland waters, drainage, desiccation, filling, or any other alteration that causes the degradation and elimination of such ecosystems (...)” (see images 12 and 13 of the digital case file, pages 11 and 12 of the complaint filed by the State). Accordingly, the matter must proceed as required by law, joining SINAC as a necessary co-plaintiff.

Finally, according to the foregoing account, in response to the hearing granted by the resolution issued at eleven hours forty-five minutes on veintisiete de octubre de dos mil veintidós, shown in image 191 of the digital case file, counsel for co-defendant [Nombre 001] stated that it agreed to join SINAC as a co-defendant (litis consorcio pasiva) (see image 195 of the digital case file). In this particular case, as previously stated, the required joinder is a joinder of necessary co-plaintiffs, and the aforementioned party has provided no reason to adopt a position different from that established by the higher court, Sala Primera de la Corte Suprema de Justicia. Therefore, in the absence of any argument to the contrary, the ruling of the Sala Primera must be applied on the terms stated above. On the other hand, counsel for the other co-defendant (Estate of [Nombre 002], see images 196 to 200 of the digital case file) opposed joining SINAC in the litigation, stating, in summary, that when the complaint was answered, judgments issued in case file 02-160268-0507-CI were attached, from which it can be verified that the property belongs to the estate, and that it therefore opposes joinder for the reasons stated.

Those objections do not concern the issue before us regarding joinder of parties (integración de la litis consorcio), but instead relate specifically to the merits of the case, for the final resolution of which it is first necessary to constitute the litigation fully; in this case, by joining SINAC’s representative. As a new party to the proceedings (sujeto procesal), SINAC must be afforded all the guarantees and rights conferred by law, according to the type and subject matter of the proceeding concerned. This logically includes the right to present its position regarding the assertions made by the aforementioned party concerning the scope and effect of the judicial rulings it cites, as well as ownership of the property at issue in the present case; the right to offer and submit evidence; the right to participate actively in the taking or production of evidence (evacuación o práctica de las pruebas), including the right to ask questions, object to questions asked by the other parties to the proceedings, and file appeals against decisions made during the evidentiary phase; and the right to challenge judicial decisions issued concerning the matter in question.

Accordingly, because these arguments concern the merits of the case rather than SINAC’s joinder as a party to the proceedings, those objections are rejected. Instead, those assertions are matters that must be resolved once all parties involved have been properly joined in this case.

Finally, the plaintiff State’s counsel addressed the hearing held on this issue in a filing shown in images 204 to 206 of the digital case file. In summary, it opposes the estate’s statements regarding the complaint referenced by that party in its filing and states that joining SINAC is necessary on the following grounds: “(...) We consider it appropriate and necessary to join the Sistema Nacional de Areas de Conservación in the litigation because that System is responsible for the administration of the northern border strip, as well as matters concerning the Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte. As we have indicated, by their nature, the lands in dispute are public-domain assets (bienes demaniales) belonging to the Patrimonio Natural del Estado, jurisdiction over which rests with SINAC. In view of the foregoing, and in order to avoid future nullities, it is appropriate to join this body in the litigation.” (see image 204 of the digital case file).

Because the position of the State’s counsel favors the joinder of SINAC ordered herein, it is unnecessary to address its foregoing arguments further. Accordingly, insofar as this litigation seeks the recognition, declaration, modification, or annulment of rights relating to areas alleged to form part of the Patrimonio Natural del Estado, it is not only prudent but also necessary, in order to comply with due process (debido proceso) and avoid potential nullities during the proceedings, to join the Sistema Nacional de Áreas de Conservación (SINAC) as a necessary co-plaintiff.

POR TANTO

The Court declares that the necessary active joinder of parties (litis consorcio activa necesaria) is incomplete, as determined sua sponte, in this proceeding brought by the STATE against [Nombre 001] AND THE ESTATE OF [Nombre 002]; the Sistema Nacional de Áreas de Conservación (SINAC) is ordered to be joined as a necessary active co-party (litisconsorte activo necesario). [Nombre 001] Nº N° 2023004470 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las diez horas con dos minutos del dieciocho de Octubre del dos mil ventitres.- Se resuelve Integración del litisconsorcio activo necesario apreciada de oficio, dentro del proceso de conocimiento establecido por el ESTADO en contra de [Nombre 001] Y SUCESION DE [Nombre 002].-

RESULTANDO

  1. 1Mediante escrito inicial de demanda presentado en fecha 07 de mayo de 2021, la parte actora acude ante este Tribunal y solicita que en sentencia se declare: "(...) 1. Declarar que los terrenos sin inscribir descritos en los planos catastrados N° H-406207-97 y N° H-392378-97, son bienes de dominio público y que forman parte del Patrimonio Natural del Estado, donde regirán las potestades de autotutela demanial administrativa por tratarse de franja fronteriza norte y a la vez áreas silvestres protegidas. //2) En virtud de la declaratoria solicitada en el extremo petitorio primero, se ordene la cancelación de los planos H-406207-97 y N° H-392378-97 en el Catastro Nacional. //3) Que por ser de dominio público, los terrenos indicados en la petitoria primera no pueden ser adquiridos por particulares por ningún título, ni inter vivos ni mortis causa. //4) Que se condene al señor [Nombre 001] al pago de los daños ambientales ocasionados en los terrenos objeto de este litigio. // 3) En caso de oposición, se impondrán ambas costas y sus intereses a la parte accionada." (ver imágenes 14 y 15 del expediente digital); asimismo, mediante escrito fechado 08 de octubre de 2021, visible a imagen 27 del expediente digital, el Estado amplía la pretensión número 4, para que se lea de la siguiente manera: "4) Que se condene al señor [Nombre 001] al pago de los daños ambientales ocasionados en los terrenos objeto de este litigio y que se establecen en el informe SINAC-ACTo-DRFVS-O-146-2021 del 26 de agosto de 2021.".
  2. 2Mediante resolución de las diez horas dieciocho minutos del diecisiete de agosto de dos mil veintiuno; se tiene por establecido el proceso de conocimiento del ESTADO contra [Nombre 001] Y SUCESIÓN DE [Nombre 002] (ver imagen 21 del expediente digital) y se otorga plazo a los accionados para su contestación; asimismo, mediante resolución de las diez horas veintiuno minutos del trece de enero de dos mil veintidós se tiene por ampliada la misma y se otorga plazo para contestar a las partes demandadas a dicha ampliación (ver imagen 150 del expediente digital).
  3. 3Mediante resolución de las once horas cuarenta y cinco minutos del veintisiete de octubre de dos mil veintidós, visible a imagen 191 del expediente digital, se confiere audiencia a las partes por el plazo de tres días hábiles sobre una posible integración del Sistema Nacional de Áreas de Conservación (SINAC) a la litis (litis consorcio activo necesario), con fundamento en lo dispuesto en el fallo 191-F-S1-2022 de la Sala Primera de al Corte Suprema de Justicia.
  4. 4En atención a la audiencia conferida mediante la resolución indicada en el punto anterior, la representación de la parte codemandada [Nombre 001], indicó estar conforme con integrar la litis consorcio pasiva con el SINAC (ver imagen 195 del expediente digital); por otro lado, la representación de la otra parte codemandada (Sucesión de [Nombre 002], ver imágenes 196 a 200 del expediente digital) se opuso a la integración del SINAC a la litis indicando, en síntesis, que desde que se contestó la demanda se adjuntaron sentencias dictadas en el expediente 02-160268-0507-CI donde indica se puede constatar que el inmueble pertenece a la sucesión, por lo que se opone a la integración de la litis por las razones expuestas. Finalmente, la representación estatal como parte actora del presente proceso se refirió respecto de la audiencia formulada en escrito visible a imágenes 204 a 206 del expediente digital, en que, en síntesis, se opone a las manifestaciones realizadas por la sucesión respecto la demanda judicial señalada por dicha parte, e indica respecto de la integración la litis lo siguiente: "(...) Consideramos pertinente y necesario integrar la litis con el Sistema Nacional de Areas de Conservación, con fundamento en que corresponde a ese Sistema la Administración de la franja fronteriza norte, así como lo correspondiente al Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte.Como hemos indicado, los terrenos en litigio, por su naturaleza, constituyen bienes demaniales que pertenecen al Patrimonio Natural del Estado, cuya competencia recae en el SINAC. Por lo anterior y a fin de evitar futuras nulidades es procedente la integración de la litis con este órgano." (ver imagen 204 del expediente digital).
  5. 5En los procedimientos se han seguido las prescripciones de rigor y no se observan causales de nulidad.-

CONSIDERANDO

I. DE LOS ARGUMENTOS DE LAS PARTES

Según el recuento antes referido, en atención a la audiencia conferida mediante la resolución de las once horas cuarenta y cinco minutos del veintisiete de octubre de dos mil veintidós, visible a imagen 191 del expediente digital, la representación de la parte codemandada [Nombre 001], indicó estar conforme con integrar la litis consorcio pasiva con el SINAC (ver imagen 195 del expediente digital); por otro lado, la representación de la otra parte codemandada (Sucesión de [Nombre 002], ver imágenes 196 a 200 del expediente digital) se opuso a la integración del SINAC a la litis indicando, en síntesis, que desde que se contestó la demanda se adjuntaron sentencias dictadas en el expediente 02-160268-0507-CI donde indica se puede constatar que el inmueble pertenece a la sucesión, por lo que se opone a la integración de la litis por las razones expuestas. Finalmente, la representación estatal actora se refirió respecto de la audiencia formulada en escrito visible a imágenes 204 a 206 del expediente digital, en que, en síntesis, se opone a las manifestaciones realizadas por la sucesión respecto la demanda señalada por dicha parte, e indica respecto de la integración lo siguiente: "(...) Consideramos pertinente y necesario integrar la litis con el Sistema Nacional de Areas de Conservación, con fundamento en que corresponde a ese Sistema la Administración de la franja fronteriza norte, así como lo correspondiente al Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte.

Como hemos indicado, los terrenos en litigio, por su naturaleza, constituyen bienes demaniales que pertenecen al Patrimonio Natural del Estado, cuya competencia recae en el SINAC. Por lo anterior y a fin de evitar futuras nulidades es procedente la integración de la litis con este órgano." (ver imagen 204 del expediente digital).-

II. SOBRE EL PATRIMONIO NATURAL DEL ESTADO

En lo que respecta al presente proceso, la denominada "teoría del caso" de la representación estatal es que los bienes indicados en la petitoria de su demanda forman parte integrante del Patrimonio Natural del Estado (PNE) donde rigen las potestades de autotela demanial, por tratarse de franja fronteriza norte y, a la vez, áreas silvestres protegidas que comprenden incluso zonas de "humedal" (ver extremo referente a la petitoria del proceso, así como también el apartado 5 de la demanda sobre "daños ambientales"). Ahora bien, sobre el régimen del Patrimonio Natural del Estado que forma parte de la "teoría del caso" de la represnetación del Estado, ha indicado este Tribunal, para citar solamente un precedente, en el fallo N°50-2022-IX de las ocho horas con veinticinco minutos del diez de noviembre del año dos mil veintidós, en lo que interesa lo siguiente: "(...) EN GENERAL SOBRE EL PATRIMONIO NATURAL DEL ESTADO: Valga recordar que el derecho fundamental a un ambiente sano y ecológicamente equilibrado, estaba reconocido y tutelado como tal en nuestro país, desde antes de la reforma al artículo 50 de la Constitución Política, por la Ley Forestal N° 4465 del 25 de noviembre de 1969 -derogada por la Ley Forestal N° 7575 del 5 de febrero de 1996-, que no sólo contenía “...como función esencial y prioridad del Estado, velar por la protección, conservación, el aprovechamiento, la industrialización, la administración y el fomento de los recursos forestales del país, de acuerdo con el principio de uso racional de los recursos naturales renovables...” (artículo 1), sino también, los conceptos de Bosque (artículo 6) y de Patrimonio Forestal del Estado (artículo 32 párrafo primero).

En cuanto al Patrimonio Forestal del Estado, la Ley Forestal N° 4465 establecía sus características (artículo 33); los órganos competentes para administrar y fiscalizar el Patrimonio Forestal del Estado, que conforme a esa normativa eran la Dirección General Forestal y el Ministerio de Ambiente y Energía (artículo 32 párrafo segundo); las potestades conferidas a estos órganos para efectos de proteger y conservar el Patrimonio Forestal del Estado, entre las que destacan: las acciones reinvindicatorias de esos inmuebles (artículo 33); la constitución dentro del Patrimonio Natural del Estado de reservas forestales, zonas protectoras, parques nacionales, refugios nacionales de vida silvestre y reservas biológicas (artículos 35 a 37); el deslinde en los terrenos de las áreas que conforman el Patrimonio Forestal del Estado (artículo 38). Por su parte, en la Ley Forestal número 7575 del 5 de febrero de 1996, que actualmente nos rige, se retoma ese concepto pero con una variación en el nombre, pues ahora se denomina Patrimonio Natural del Estado, el cual, es un término más amplio que abarca la protección y preservación del ecosistema boscoso (artículo 3 inciso c de la Ley Forestal).

El Patrimonio Natural del Estado es de dominio público, razón por la cual, los terrenos y bosques comprendidos en él son inembargables, imprescriptibles e inalienables; en tanto, su conservación y administración están confiadas por ley al Ministerio de Ambiente y Energía, a través del Sistema Nacional de Áreas de Conservación (artículos 6.a, 13 párrafo segundo y 14 de la Ley Forestal, 32 párrafo segundo de la Ley Orgánica del Ambiente). Además, está integrado por dos importantes componentes: 1) Las Áreas Silvestres Protegidas, cualquiera que sea su categoría de manejo y que se hayan declarado por Ley o por Decreto Ejecutivo, a saber: reservas forestales, zonas protectoras, parques nacionales, reservas biológicas, refugios nacionales de vida silvestre, humedales y monumentos naturales (Ley Forestal 7575, artículos 1°, párrafos 2°, 3° inciso i; Ley Orgánica del Ambiente N° 7554, artículo 32; Ley de Biodiversidad N° 7788, artículos 22 y siguientes y 58; Ley del Servicio de Parques Nacionales N° 6084, artículo 3° incisos. d y f, en relación con la Ley Orgánica del MINAE N° 7152 y su Reglamento; Ley de Conservación de la Vida Silvestre N° 7317, numeral 82, inciso a); y 2) Los demás bosques y terrenos forestales de las áreas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a las municipalidades, instituciones autónomas y demás organismos de la Administración Pública, que tienen una afectación legal inmediata (ordinal 13 párrafo primero de la Ley Forestal) / [al respecto se puede consultar la sentencia número 2008-16975 dictada por la Sala Constitucional de la Corte Suprema de Justicia, a las 14:53 horas del día 12 de noviembre del año 2008].

Sobre el particular además, la Sala Primera de la Corte Suprema de Justicia ha indicado que: “(…) Conforme al numeral 13 de la Ley Forestal “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio...” De esta forma, son tres posibilidades las que brinda la norma, respecto a los bienes que integran dicho patrimonio: a) bosques y terrenos forestales de las reservas nacionales; b) bosques y terrenos forestales de las áreas declaradas inalienables, y c) bosques y terrenos forestales de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.

De esta forma, el criterio externado por el IDA, respecto a que la finca objeto de este proceso no puede considerarse parte del patrimonio natural del Estado, ya que no se localiza dentro de una reserva nacional, un área silvestre protegida, una reserva forestal o biológica, surge de una indebida interpretación del ordinal citado. En este sentido, el mandato 13 ibídem es claro al determinar, que una propiedad cubierta de bosque, y que pertenezca al Estado, una municipalidad, institución autónoma u otro organismo de la Administración Pública, forma parte del patrimonio natural del Estado, sin requerir el Legislador, que la propiedad debiera formar parte de alguna de las categorías de protección indicadas.” (Al respecto pueden consultarse las sentencias números 1070 de las 9:45 horas del 03 de setiembre de 2010 y 1088 de las 8:55 horas del 8 de agosto de 2011). Ahora bien, otro aspecto que resulta de vital importancia indicar, es que el Patrimonio Natural del Estado no requiere de una declaratoria expresa dado que, conforme a lo establecido en los artículos 13 y 14 de la Ley Forestal, así como lo resuelto por la Sala Constitucional en sus sentencias 1992-03789 y 1997-04587, las zonas boscosas, los terrenos con aptitud forestal, los manglares y los humedales comprendidos dentro de las áreas inalienables, como la zona marítimo terrestre, quedan afectadas de forma inmediata a este Patrimonio, sin concurrencia de la Administración.

En ese sentido, es evidente que el Estado -en el sentido amplio del término- tiene el deber legal y constitucional de garantizar, defender y proteger las zonas boscosas, los terrenos de aptitud forestal, los manglares, los humedales, entre otros, comprendidos en las áreas inalienables, debiendo tomar las medidas necesarias para su protección y conservación efectivas." (destacado propio). Por otro lado, sobre la naturaleza jurídica del Sistema Nacional de Áreas de Conservación (SINAC) se ha indicado por parte de este Tribunal, en distintos fallos, que se trata de un órgano con personalidad jurídica instrumental (ver, entre otros el fallo N° 62-2022 de las trece horas cuarenta minutos del diecisiete de enero de dos mil veintidós, así como en fallo N° 247-2016-T de las quince horas y dieciocho minutos del día cuatro de febrero de dos mil dieciséis, entre muchos otros).

III. SOBRE LA LITIS CONSORCIO NECESARIO

El artículo 71 del Código Procesal Contencioso Administrativo (CPCA), establece que el litis consorcio necesario se integrará de oficio o a gestión de parte, hasta antes del dictado de la sentencia. Un aspecto esencial dentro de un proceso jurisdiccional, es lo relativo a la determinación de los sujetos que deben intervenir dentro del mismo, lo que se determina teniendo como base la relación jurídica-administrativa subyacente en la litis planteada, esto con el fin de que el Órgano Jurisdiccional pueda hacer un pronunciamiento de fondo que surta sus efectos entre los sujetos que corresponde, en tanto no es posible verter sentencia de fondo fraccionando las relaciones jurídicas materiales o calificándolas sólo en relación de algunos de sus sujetos, pues la decisión debe englobar y obligar a todos los sujetos que son parte de aquella relación. Sobre la necesaria integración del litis consorcio pasivo ha indicado este Tribunal, entre otros, en el fallo N°1012-2021-T de las diez horas cincuenta y cinco minutos del treinta de julio de dos mil veintiuno, lo siguiente: "La Sala Primera de la Corte Suprema de Justicia, en funciones de Tribunal de Casación de lo Contencioso-Administrativo, ha tratado en varias ocasiones el tema, estableciendo que esta figura implica la existencia de relaciones jurídicas materiales respecto de las cuales no es posible pronunciarse fraccionándolas o calificándolas sólo en relación de algunos de sus sujetos, pues la decisión engloba y obliga a todos.

La presencia de todos los sujetos es indispensable para que la relación procesal se complete y sea posible decidir en sentencia sobre el fondo de la misma (Resolución número 156-F-TC-2008, de 8:45 horas del 7 de noviembre, citando las resoluciones números 824-2000 de las 16 horas 05 minutos del primero de noviembre de 2000 y 482-2005 de las 10 horas 30 minutos del 07 de julio de 2005). Ha indicado la Sala además, que con esta figura se busca garantizar la participación y defensa en el proceso a todos los sujetos cuya esfera jurídica sustancial será afectada con la resolución definitiva del asunto, sea porque la pretensión deba ser planteada por un cúmulo de sujetos, titulares del interés subjetivo cuya tutela o reconocimiento se reclama (litis consorcio activo necesario) o, por cuanto aquélla debe indefectiblemente dirigirse en su contra (litis consorcio pasivo necesario). En cuanto al litis consorcio pasivo necesario, ha indicado además la Sala Primera, que este instituto procura garantizar la correcta formación del contradictorio procesal, ya que al ser indivisible la relación sustancial, es indispensable en lo que atañe a la parte demandada, que al proceso concurran todos los sujetos a quienes corresponda contradecir la pretensión deducida.

De ello deriva la importancia de que el litis consorcio se integre debidamente, toda vez que, de lo contrario, no podrá conocerse el fondo del asunto y la sentencia no podrá pronunciarse respecto de la situación jurídica sustancial debatida en el proceso, pues no puede afectar o perjudicar a quien no ha sido parte con el necesario cumplimiento del debido proceso (Resolución Nº 156-F-TC- 2008, de las 8:45 horas del 7 de noviembre, citando las resoluciones números 29-F-TC-2008 de las 14:15 horas del 8 de mayo de 2008, 30-F-TC-2008 de las 14:20 del 8 de mayo de 2008 y Nº 63-A-TC-2008 de las 9:45 horas del 11 de junio del 2008). En otras palabras, será necesaria la integración cuando la relación jurídica involucre a una parte que no está presente en el proceso.- En la especie debe valorarse los supuestos procesales para determinar una posible integración de la litis, por un lado, que responda a un mandato legal, cuya concurrencia de todas las partes está prevista por el mismo ordenamiento jurídico.- Y por otro lado que las pretensiones se orienten a otros sujetos y/o que las relaciones jurídicas subyacentes impliquen que para el dictado de la sentencia sea necesario integrarlos en resguardo del debido proceso y el derecho de defensa, y para evitar indefensiones que generen posibles nulidades de las actuaciones.-" (destacado propio).

Así las cosas, es indispensable en lo que atañe a la parte demandada, que al proceso concurran todos los sujetos a quienes corresponda contradecir la pretensión deducida, pues, en caso contrario, no podrá conocerse el fondo del asunto y la sentencia no podrá pronunciarse respecto de la situación jurídica sustancial debatida en el proceso, pues no puede afectar o perjudicar a quien no ha sido parte con el necesario cumplimiento del debido proceso. [Bajo esta linea de pensamiento se encuentra las sentencias número 29-F-TC-2008, de las catorce horas quince minutos del ocho de mayo; número 30-F-TC-2008, de las catorce horas veinte minutos del ocho de mayo; 63-A-TC-2008, de las nueve y cuarenta y cinco minutos del once de junio y número 156-F-TC-2008, de las ocho horas cuarenta y cinco minutos del siete de noviembre, todas dictadas por la Sala Primera de la Corte Suprema de Justicia en el año dos mil ocho].

Asimismo, en casos similares al que nos ocupa en el presente expediente, el Tribunal Contencioso Administrativo, ha señalado mediante la resolución N° 349-2021 de las quince horas cero minutos del diecisésis de marzo de dos mil veintiuno lo siguiente sobre la figura que nos interesa: "La Sala Primera de la Corte Suprema de Justicia actuando como Tribunal de Casación de lo Contencioso Administrativo, a través de su jurisprudencia, ha señalado que la figura del litis consorcio, en cualquiera de sus modalidades, ya sea activa o pasiva, constituye una garantía de participación y defensa de todos los sujetos cuya esfera de derechos pueda resultar afectados con la resolución de fondo de determinado caso. Es por tanto, una forma de garantizar el contradictorio, de modo tal que se asegure la concurrencia de todos aquellos sujetos a quienes les corresponda contradecir la pretensión, pues su acogimiento de una u otra forma, puede resultar en perjuicio de sus derechos o intereses legítimos.

(Al respecto pueden revisarse los votos 824-2000 del 01de noviembre del 2000; 9-F-TC-2008 del 8 de mayo de 2008; 30-F-TC- 2008 del 8 de mayo de 2008; 63-A-TC-2008 del 11 de junio de 2008, todos citado en la resolución 185-2009 del 27 de agosto del año 2009 del Tribunal de Casación Contencioso Administrativo y Civil de Hacienda). En el mismo sentido, el Tribunal de Apelaciones de lo Contencioso Administrativo, en lo que resulta aplicable al caso concreto ha sostenido: "Al efecto se debe razonar que por ende es necesario que la persona este presente en un proceso judicial cuya resolución le afecta de manera directa; sobre todo por un principio de eficacia de la resolución que se dicte; pues una persona no puede ser afectada por la decisión si no ha tenido oportunidad de ser parte y alegar los argumentos que estime pertinentes en defensa de su situación jurídica. Lo contrario produciría un estado de indefensión procesal que produciría la nulidad de lo actuado, además impediría ejecutar una eventual sentencia contraria a la posición que la representación que ese ente pudiera tener." (Ver voto 638 del 30 de noviembre del 2010).

Así, el artículo 71 del Código Procesal Contencioso Administrativo, establece que el litis consorcio necesario se integrará de oficio o a gestión de parte, hasta antes del dictado de la sentencia. Y con respecto a los sujetos que deben ser llamados a juicio en el proceso contencioso administrativo, el artículo 12 del dicho cuerpo legal plantea: “ARTÍCULO 12.- Se considerará parte demandada:

  • 1)La Administración Pública autora de la conducta administrativa objeto del proceso, salvo cuando se trate de los Poderes Ejecutivo, Legislativo, Judicial y del Tribunal Supremo de Elecciones; en este caso, se demandará al Estado.
  • 2)Los órganos administrativos con personalidad jurídica instrumental, en tanto sean autores de la conducta administrativa objeto del proceso, conjuntamente con el Estado o el ente al que se encuentren adscritos.
  • 3)Las personas físicas o jurídicas que hayan derivado derechos e intereses legítimos de la conducta administrativa objeto del proceso.
  • 4)Cualquier otra persona que haya sido llamada al proceso como responsable, en su carácter funcional o personal.
  • 5)La Contraloría General de la República: a) Conjuntamente con el Estado, cuando el proceso tenga por objeto la conducta administrativa de aquella, relacionada con el ejercicio de su competencia constitucional y legal. b) Conjuntamente con el ente fiscalizado, cuando el proceso tenga por objeto una conducta administrativa sometida a su control, en el ejercicio de sus potestades de fiscalización o tutela superior de la Hacienda Pública.
  • 6)Cuando una entidad dicte algún acto o disposición que, para su firmeza, requiera previo control, autorización, aprobación o conocimiento, por parte de un órgano del Estado o de otra entidad administrativa, se tendrá como parte demandada: a) El Estado o la entidad que dictó el acto o la disposición fiscalizados, si el resultado de la fiscalización ha sido aprobatorio. b) La entidad que ha ejercido la fiscalización, si esta no ha aprobado el acto o la disposición.
  • 7)Cuando una entidad dicte algún acto o disposición, que en virtud de un recurso administrativo no jerárquico -facultativo u obligatorio- deba ser conocido por parte de un órgano del Estado o de otra entidad administrativa, se tendrá como parte demandada: a) El Estado o la entidad que dictó el acto, cuando este ha sido confirmado. b) La entidad que, conociendo el recurso, anula, revoca o reforma la conducta cuestionada.
  • 8)Si el demandante funda sus pretensiones en la ilegalidad de una disposición general, se considerará también parte demandada a la Administración autora de esta, aunque la actuación recurrida no procede de ella..". Los anteriores incisos constituyen supuestos en los que resulta necesaria la integración de la litis y adicionalmente, debe considerarse la necesaria integración si por la naturaleza de la relación jurídico material del proceso, la decisión debe realizarse con varias personas que deberán ser demandadas. Por lo que entonces corresponde verificar si lo anterior, resulta aplicable al presente caso.// (...) Para el análisis de este asunto, es necesario tomar en consideración los hechos y las pretensiones planteadas en el escrito de la demanda, los argumentos de las partes y de la prueba aportada en autos, advertido lo anterior se realizará el estudio respectivo. a) Respecto a los argumentos de integrar a la litis al Estado y al Instituto Costarricense de Turismo, considera esta Juzgadora que es necesaria su participación en la litis a efectos de dirimir el conflicto toda vez que no solamente se pretenda determinar la existencia de responsabilidad objetiva del ente municipal sino que la contención surge del eventual traslape entre lo concesionado (zona marítimo terrestre) y un bien particular, propiedad de (...). Al respecto debe puntualizarse que a pesar de que la parte actora no formula pretensiones en contra del Estado, ni del Instituto Costarricense de Turismo, ni tampoco la conducta objeto del proceso fue adoptada por éstos, ni se le exige conducta alguna de forma directa o indirecta, lo cierto del caso es que, en la especie, lo que se cuestiona es un eventual traslape de la zona marítimo terrestre con propiedad privada y se pretende la nulidad de la concesión número (...) otorgada por la Municipalidad de Garabito a favor del señor (...) , inscrita bajo la matrícula de folio real del Partido de Puntarenas, (...). Así, es claro, que el objeto del proceso está directamente relacionado con el área de la zona marítimo terrestre y de acuerdo con el numeral 1 de la Ley No. 6043, "La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su protección, así como la de sus recursos naturales, es obligación del Estado, de sus instituciones y de todos los habitantes del país. Su uso y aprovechamiento están sujetos a las disposiciones de esta ley." Lo anterior significa que, aunque las entidades municipales posean el usufructo y administren la zona marítimo terrestre (art. 3 ibíd.), aquella pertenece al Estado y en efecto, el artículo 4 de la misma Ley, dispone que "La Procuraduría General de la República, por sí o a instancia de cualquier entidad o institución del Estado o de parte interesada, ejercerá el control jurídico para el debido cumplimiento de las disposiciones de esta ley. En consecuencia, hará las gestiones pertinentes respecto a cualesquiera acciones que violaren o tendieren a infringir estas disposiciones o de leyes conexas, o que pretendan obtener derechos o reconocimiento de estos contra aquellas normas, o para anular concesiones, permisos, contratos, actos, acuerdos o disposiciones obtenidos en contravención a las mismas." Esta norma resulta de suyo relevante, ya que en el proceso se pretende la anulación de un derecho de concesión (pretensión No. 4 contra la Municipalidad de Garabito); asimismo el artículo 2 de la misma Ley establece: "Corresponde al Instituto Costarricense de Turismo, en nombre del Estado, la superior y general vigilancia de todo lo referente a la zona marítimo terrestre". Como se aprecia, en el tanto, que en la litis se pretenda la obtención, reconocimiento o anulación de derechos sobre áreas de la zona marítimo terrestre, resulta prudente y acorde al debido proceso, a efecto de evitar futuras nulidades, integrar al Estado y al Instituto Costarricense de Turismo al presente proceso. En consecuencia, se acoge la defensa previa de falta de integración de la litis pasivo necesaria y por ende, se ordena integrar al ESTADO y al INSTITUTO COSTARRICENSE DE TURISMO en condición de litisconsorte pasivo. Se previene a la parte accionante que en el plazo tres días hábiles, aporte una copia completa, física o digital, de este proceso con el objeto de notificar a los integrados." (destacado propio). Así las cosas, según los precedentes antes señalados, con esta figura se busca garantizar la participación y defensa en el proceso a todos los sujetos cuya esfera jurídica sustancial será afectada con la resolución definitiva del asunto, sea porque la pretensión deba ser planteada por un cúmulo de sujetos, titulares del interés subjetivo cuya tutela o reconocimiento se reclama (litis consorcio activo necesario) o, por cuanto aquélla debe indefectiblemente dirigirse en su contra (litis consorcio pasivo necesario). Ahora bien, la regulación de la figura del litis consorcio activo necesario, se encuentra regulada en el numeral 22.1. del Código Procesal Civil vigente, aplicable a esta materia en virtud de lo dispuesto por el artículo 220 del Código Procesal Contencioso Administrativo (CPCA), y, en lo que interesa dispone: "22.1 Litisconsorcio necesario. Cuando por disposición de la ley o por la naturalea de la relación jurídica material, la decisión deba hacerse con varias personas, estas deberán demandar o ser demandadas en el mismo proceso (...)". Resulta evidente entonces de los precedentes antes citados de este Tribunal, tal como se verá en detalle más adelante, que en el tanto se pretenda en la litis la obtención, reconocimiento, modificación o anulación de derechos sobre áreas que se indica forman parte del Patrimonio Natural del Estado, en el tanto se pretende declarar por medio de la presente causa que integran la franja fronteriza norte y áreas silvestres protegidas, resulta prudente y acorde al debido proceso, a efecto de evitar futuras nulidades, integrar a la litis al SINAC, en este caso en virtud de un litis consorcio activo necesario, según se verá a continuación.

IV. SOBRE EL CASO CONCRETO

Para el análisis de este asunto, es necesario tomar en consideración los hechos y las pretensiones planteadas en el escrito de la demanda, los argumentos de las partes, así como la prueba aportada en autos, advertido lo anterior se realizará el estudio respectivo. Este Tribunal Contencioso Administrativo y Civil de Hacienda, tomando en consideración la naturaleza jurídica de órgano con personalidad jurídica instrumental del SINAC, ha ordenado su integración en los siguientes términos: "ÚNICO: DEL LITIS CONSORCIO PASIVO NECESARIO EN EL CASO CONCRETO: El litisconsorcio pasivo necesario, supone que para resolver el asunto deben estar presentes en el proceso todos aquellos sujetos a los que tal resolución puede afectar en sus intereses o derechos. En otras palabras, esta figura determina la imposibilidad de configurar válidamente un proceso y dictar una sentencia, sin contar con la presencia y la efectiva participación de todos y cada uno de los sujetos a los que la relación material involucra o cuya presencia se exija por ley, con el fin de que puedan ejercer su defensa.

Habiéndose analizado tanto el escrito de interposición de medida cautelar como el de contestación del Estado, donde éste señala que resuelta necesario integrar como parte dentro de este proceso al Sistema Nacional de Áreas de Conservación (SINAC), por ser un órgano con personalidad jurídica instrumental del Ministerio de Ambiente y Energía, se determina la necesidad de integrarlo como parte demandada, ello al tenor de lo dispuesto en el inciso 2) del artículo 12 del Código Procesal Contencioso Administrativo, pues la presente litis no puede resolverse válidamente sin su participación, por disposición legal. En consecuencia, se ordenar integrar al Sistema Nacional de Áreas de Conservación, como litis consorte pasivo en el presente proceso. Así las cosas, previo a dar traslado de la solicitud de medida cautelar a dicho órgano y bajo el apercibimiento de no atender futuras gestiones, se le previene a la parte gestionante, en el plazo de tres días, aportar un juego completo de copias de todo lo actuado a la fecha." (Tribunal Contencioso Administrativo y Civil de Hacienda, N° 247-2016-T de las quince horas y dieciocho minutos del día cuatro de febrero de dos mil dieciséis, destacado propio).

En este caso, ambas partes concuerdan con que el objeto del proceso está directamente relacionado con una declaratoria que se pide relacionada con un área ubicada descrita en los planos N° H-406207-97 y N° H-392378-97 que la representación estatal como parte actora señala como integrantes del Patrimonio Natural del Estado, por tratarse de franja fronteriza norte y a la vez áreas silvestres protegidas. Ahora bien, en casos similares al presente en que se han formulado pretensiones similares a las que nos ocupa se ha ordenado integrar a la litis a la representación del SINAC, para lo cual puede verse, entre otros, el fallo de este Tribunal de las quince horas cuarenta minutos del primero de febrero de dos mil diecinueve (dictado en el expediente 16-000033-0387-AG) en que se dispuso también la integración del SINAC en los siguientes términos: "III. SOBRE EL CASO CONCRETO: Del análisis del caso concreto, se observa que la parte actora plantea un conflicto por el eventual traslape entre los inmuebles del partido de Guanacaste números: [Valor 001], [Valor 002] y [Valor 003] de su propiedad y los inmuebles [Valor 004] y [Valor 005] cuyos propietarios son en su orden, [Nombre 004] y [Nombre 005].

En este sentido, el Registro Público Inmobiliario en resolución de las catorce horas del del 8 de marzo de 2017, dictada en el expediente administrativo 2015-1598-RIM, señala que "...las fincas [Valor 006] y 038779 tienen su origen a partir de la apertura de los asientos, luego de las diligencias de información posesoria respectivas, situación que se dio el 01 de marzo del año 1977. Para esta fecha estaba ya vigente la Ley No. 2825 (del 14 de octubre de 1961) misma que señala como inalienables e imprescriptibles aquellos terrenos situado a los dos kilómetros más próximos de la Frontera con Nicaragua (...) el Decreto No.22962 MIRENEM, declara dicha zona como Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte (...)" -continúa indicado la resolución en el punto Seis- "En consecuencia, y de conformidad con los traslapes detectados por el Departamento Catastral Técnico, los cuales no solo abarcan terrenos pertenecientes a otros particulares, sino también terrenos que se encuentran dentro de la zona inalienable, -por ser fronteriza y zonas de protección del ambiente..." (imágenes 520 a 549 del expediente digital).

Lo extraído hace referencia a que (sic) que las fincas objeto de litigio podrían encontrarse dentro de la Franja Fronteriza Norte y en este sentido, de conformidad con el Decreto No.22962 MIRENEM, esa zona fue declarada Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte, al respecto el artículo 1 de dicho decreto dispone: "Declárase Refugio Nacional de Vida Silvestre al corredor fronterizo conformado por los terrenos comprendidos en una zona de 2 000 m de ancho a lo largo de la frontera con Nicaragua desde Punta Castilla en el Mar Caribe hasta Bahía Salinas en el Océano Pacífico, según se dispone en el Tratado Cañas-Jerez del 15 de abril de 1858". Ahora bien, de conformidad con los artículos 13 de la Ley Forestal y 22 de la Ley de Biodiversidad, corresponde al Sistema Nacional de Áreas de Conservación, la administración y defensa del patrimonio natural del Estado, de manera que considerando la declaratoria de Refugio Nacional de Vida Silvestre al corredor fronterizo -que como ya se indicó- se encuentran los inmuebles objeto del presente litigio, es que esta Juzgadora puede concluir que una eventual sentencia estimatoria podría incidir de forma directa y inmediata en el patrimonio natural del Estado y requiere la necesaria intervención plena del órgano encargado, sea el Sistema Nacional de Áreas de Conservación (SINAC), por cuanto la relación jurídico sustancial involucra de manera directa las competencias de ese órgano.

Por lo anterior y conforme con el artículo 22.1. del Código Procesal Civil y el 220 del Código Procesal Contencioso Administrativo se ordena integrar en calidad de litisconsorte pasivo necesario al Sistema Nacional de Áreas de Conservación." (destacado propio). En este caso, la pretensión primera de la representación estatal está relacionada con una eventual declaratoria relacionada con las fincas objeto de litigio y se pide declarar que son bienes de dominio público, donde rigen las potestades de autotela demanial, por tratarse de franja fronteriza norte y áreas silvestres protegidas, por lo que en el caso está en discusión si dichos bienes podrían encontrarse dentro de la Franja Fronteriza Norte y en este sentido, de conformidad con el Decreto No.22962 MIRENEM, esa zona fue declarada Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte, de manera que una eventual sentencia estimatoria podría incidir en forma directa e inmediata en el patrimonio natural del Estado, por lo que se requiere la necesaria integración plena del órgano encargado, sea el Sistema Nacional de Áreas de Conservación (SINAC).

Restaría entonces determinar la calidad en que intervendría el SINAC, por cuanto, a diferencia del precedente antes citado, en este caso el Estado figura como parte actora y es quien pretende la declaratoria antes indicada en relación con la demanialidad de los bienes. En un caso similar al precente, el Superior de la materia la Sala Primera de la Corte Suprema de Justicia, mediante resolución 000191-F-S1-2022 de las nueve horas cuatro minutos del tres de febrero de dos mil veintidós, ordenó la integración del SINAC, incluso en sede de casación, y ante la ausencia del Estado y el SINAC en virtud de litis consorcio activo necesario, ordenó incluso el reenvío de la causa al Tribunal para que se procediera conforme a derecho corresponde, integrando al SINAC y al Estado a la litis consorcio activo necesario. Lo anterior lo dispuso el Superior de la materia, en síntesis, en los siguientes términos: "(...) hay un aspecto subyacente que resulta primordial, —por ello no puede dejarse de lado al momento de resolver la controversia—, a saber, está de por medio un bien de dominio público, que atañe a la protección del medio ambiente (norma 50 de la Constitución Política), y perteneciente al patrimonio natural del Estado (PNE), por lo cual concierne al interés público.

Por otro lado, el propio Tribunal transcribió parte de un fallo de la Sala Constitucional, donde se dispuso la “…legislación nacional desarrolla tal compromiso en algunas leyes como la Ley Orgánica del Ambiente, ley Nº 7554 de 28 de setiembre de 1995, la cual en el artículo 32, incluyó a los Humedales en las distintas categorías de manejo de las áreas silvestres protegidas, que están bajo la administración del Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET) -con la colaboración de las municipalidades- y los declara de interés público, así como a su conservación. Sobre la “Convención relativa a los Humedales de Importancia Internacional especialmente como Hábitat de aves acuáticas, o Convención de Ramsar”. Costa Rica ha suscrito numerosos instrumentos internacionales que protegen nuestra riqueza ecológica y que en el fuero interno, son legislación plenamente aplicable -y de exigibilidad judicial directa-.

Por ende, decidió, resultaba inconstitucional exigir la declaratoria de un humedal y su zona de influencia como áreas protegidas, se tuviera que hacer mediante Decreto Ejecutivo, debiendo tan solo seguir los requisitos definidos en la Ley Orgánica del Ambiente, para lo cual el Estado se encuentra posibilitado de expropiar o cancelar los terrenos privados. Aunque enfatizó, ello no conllevaba descartar la existencia y protección de los ecosistemas del humedal, únicamente por no haberse declarado área silvestre protegida o encontrarse en propiedad privada. El Tribunal constitucional, recalcó en el plano internacional la Convención Ramsar, fue ratificada por la Asamblea Legislativa en la Ley no. 7224 del 9 de abril de 1991, la cual dispone en su artículo primero la importancia internacional de los humedales y su protección. Agregó: “IV.- Sobre los humedales y su importancia ambiental, cultural y económica.

Esta Sala se ha referido a la relevancia de estos ecosistemas y su protección, en las sentencias 2001-12817 de las 10:28 horas del 14 de diciembre del 2001 y 2007-6246 de las 19:30 horas del 8 de mayo del 2007, entre otras, señalando que los humedales son considerados de los ecosistemas más productivos del mundo. En la Convención de Ramsar, suscrita el 2 de febrero de 1971, el humedal es definido como: “Extensiones de marismas, pantanos, turberas o aguas de régimen natural o artificial, permanentes o temporales, estancadas o corrientes, dulces, salobres o saladas, incluyendo las extensiones de agua marina cuya profundidad en marea baja no exceda de seis metros”. En Costa Rica, la Ley Orgánica del Ambiente en el artículo 40, los ha definido como: “Ecosistemas con dependencia de regímenes acuáticos, naturales o artificiales, permanentes o temporales, lénticos o lóticos, dulces, salobres o salados, incluyendo extensiones marinas hasta el límite posterior de fanerógamas o arrecifes, o en su ausencia, hasta seis metros de profundidad en marea baja”.

La importancia de los humedales no lo es sólo en función de la biodiversidad y de las que se desarrollan a escala ecológica, sino porque proveen de funciones de apoyo y productos esenciales para las comunidades humanas en el mundo en desarrollo e industrializado… Además, presentan atributos muy valiosos como la diversidad biológica y la singularidad del patrimonio cultural. Es la combinación de estas funciones, productos y atributos de los ecosistemas la que hace que los humedales sean importantes para la sociedad… la Ley Orgánica del Ambiente, ley Nº 7554 de 28 de setiembre de 1995… en el artículo 32, incluyó a los Humedales en las distintas categorías de manejo de las áreas silvestres protegidas, que están bajo la administración del Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET) -con la colaboración de las municipalidades- y los declara de interés público, así como a su conservación”.

En este punto, es menester referir a lo expresado por este Órgano decisor en cuanto a que la legitimación constituye un presupuesto de toda relación procesal, -de fondo-, necesario para la procedencia de la pretensión material, es decir, será parte legítima quien alega tener una determinada relación jurídica con la petitoria debatida. De ahí, es la aptitud para ser parte en un proceso concreto, puede ser activa o pasiva, lo cual dependerá de las condiciones que para tal efecto establezca la ley en cuanto la pretensión procesal. Así, la legitimación ad causam activa, de interés en la especie, es la capacidad para demandar, carácter que nace de la posición en que se encuentre el sujeto, respecto a la pretensión procesal formulada y concierne a la persona que de acuerdo con la ley puede formular las pretensiones de la demanda. En síntesis, es la identidad necesaria que debe darse entre el demandante y el derecho que pretenda en juicio.

Se trata por ende de una legitimación para obtener sentencia de fondo o mérito. Así, le corresponde al actor y a las personas que con posterioridad intervengan para defender su causa. Su ausencia constituye un impedimento sustancial, si el juzgador se percata de la falta de esta, así debe declararlo aún de oficio y dictar una sentencia inhibitoria. Sobre este particular, en el proceso, en lo que interesa, la Municipalidad de Belén solicitó la integración de la litis con el Estado. En resolución no. 938-2013 de 15 horas 30 minutos del 13 de mayo de 2013, el Juez tramitador rechazó dicho pedido, en su lugar ordenó notificar a la Procuraduría General de la República como tercer interesado, quien participó como tal. Como se expresó, en el objeto del proceso subyace un aspecto fundamental como lo es la protección de un humedal, —parte integrante del patrimonio natural del Estado— y bien de dominio público.

Por consiguiente, es claro, el Tribunal omitió en su examen que está de por medio la protección de un humedal, —el cual cuenta con la correspondiente declaratoria según se expuso supra—, conformante del patrimonio natural del Estado y que es un bien del demanio público, cuya administración es competencia del MINAE mediante el SINAC (sentencias de esta Sala números 1239 de 11 horas 50 minutos del 31 de marzo de 2020 y 19776-2014 de 10 horas 30 minutos del 3 de diciembre de 2014). Así, esta Cámara estima, el Estado y el SINAC debieron haber sido integrados a la litis, a fin de completar el litis consorcio activo por estar incompleto. Ello de conformidad con lo preceptuado en el cardinal 106 del Código Procesal Civil derogado, el cual debe actuarse en la especie debido a la remisión realizada por el canon 220 del CPCA y por ser el vigente al momento de iniciarse el presente caso; dado que obliga a la integración de la litis sea por disposición legal o por la naturaleza de la relación jurídica material, —como en la especie—, pues lo que se resuelva incumbe a tales intervinientes, quienes por la naturaleza del bien (humedal, conformante del PNE) deben intervenir como coactores.

Ha de agregarse, solo de esta forma se logrará resolver la controversia, pues, según se indicó, es al SINAC a quien le corresponde fijar la extensión del humedal, al igual que el retiro respecto a obras urbanísticas o de cualquier especie que puedan influir negativamente en el ecosistema protegido. // IV.- En estas circunstancias, lo pertinente será de oficio ordenar integrar la litis trayendo al proceso al Estado y al SINAC como codemandantes, pues ambas entidades tienen una clara responsabilidad ex legge en el manejo y control de las áreas parte del PNE. Por ende, su participación es indispensable, ya que forman parte de las relaciones jurídicas sobre las cuales ha de pronunciarse el fallo. De ahí, se anulará la sentencia dictada en el presente proceso y se reenviará el expediente al Tribunal para que proceda conforme a derecho corresponde, integrando al Estado y al SINAC al litis consorcio activo necesario. // (...) // POR TANTO // Se anula la resolución recurrida.

Reenvíese al Tribunal para que proceda conforme a derecho corresponda, integrando al SINAC y al Estado a la litis consorcio activo necesario. Por mayoría, se conserva la prueba evacuada que resulte útil y necesaria para la resolución de la controversia. Salvan el voto las magistrados Rivas Loáiciga y López Casal." (destacado propio). En el caso concreto, los razonamientos antes indicados realizados por la Sala Primera de la Corte Suprema de Justicia resultan aplicables al caso que nos ocupa, por lo que estima este juzgador que el SINAC debe ser integrado a la litis, a fin de completar el litis consorcio activo por estar incompleto; lo anterior, por cuanto lo que se resuelva en este caso incumbe a tales intervinientes (Estado - SINAC), quienes por la naturaleza del bien (que se pretende comprenden humedal y zonas conformantes del PNE) deben intervenir como coactores. Nótese que incluso la demanda formulada por la representación estatal indica que en la zona se localizan "humedales" al igual que en el precedente de Sala Primera antes citado al señalar la representación estatal en su demanda lo siguiente: "Según el oficio SINAC-ATCTO-DIR-137-2021 (que se ofrece como prueba), dentro de los terenos descritos en el plano H-392378-97 se localizan humedales registrados en el inventario FID 2321, denominado San Luis 2, con 257,2 hectáreas de tipo Palustre Pantano Herbáceo y el FID 2318, denominado Palustre San Luis 3, con 3,627.1 hectáreas de tipo Palustre Pantano de cativo y yolillo.

(...) Los humedales están protegidos en nuestro ordenamiento por la Ley Orgánica del Abmiente artículos 32 f), art. 40, 41, y 45. Este último prohíbe las actividades orientadas a interrumpir los ciclos naturales de los ecosistemas de humedal, como la construcción de diques que eviten el flujo de las aguas marinas o continentales, drenajes, desecamiento, relleno o cualquier otra alteración que provoque el deterioro y la eliminación de tales ecosistemas (...)" (ver imágenes 12 y 13 del expediente digital, páginas 11 y 12 de la demanda formulada por el Estado). Así las cosas, debe procederse conforme en derecho corresponde, integrando al SINAC a la litis consorcio activo necesario. Finalmente, según el recuento antes señalado, en atención a la audiencia conferida mediante la resolución de las once horas cuarenta y cinco minutos del veintisiete de octubre de dos mil veintidós, visible a imagen 191 del expediente digital, la representación de la parte codemandada [Nombre 001], indicó estar conforme con integrar la litis consorcio pasiva con el SINAC (ver imagen 195 del expediente digital); en este caso particular, tal como ha quedado antes señalado, la integración de la litis consorcio necesaria se configura como litis consorcio activo necesario sin que la parte citada indique motivo alguno para considerar una posición distinta a la señalada por el Superior Sala Primera de la Corte Suprema de Justicia, por lo que, ante la ausencia de argumento en contrario debe aplicarse lo resuelto por la Sala Primera en los términos antes indicados.

Por otro lado, la representación de la otra parte codemandada (Sucesión de [Nombre 002], ver imágenes 196 a 200 del expediente digital) se opuso a la integración del SINAC a la litis indicando, en síntesis, que desde que se contestó la demanda se adjuntaron sentencias dictadas en el expediente 02-160268-0507-CI donde indica se puede constatar que el inmueble pertenece a la sucesión, por lo que se opone a la integración de la litis por las razones expuestas. Con respecto a tales argumentos de oposición, se trata de afirmaciones que no son propias del tema que nos ocupa referente a la integración de la litis consorcio, sino mas bien referidos precisamente al fondo del asunto, para cuya resolución defintiva resulta necesario primero conformar la litis en forma completa; en este caso, integrando a la representación del SINAC. Al SINAC como nuevo sujeto procesal se les debe conceder todas las garantías y derechos que la ley les confiere, según el tipo y materia del proceso de que se trate, lo cual incluye, lógicamente, el derecho a ventilar su posición respecto de las afirmaciones realizadas por la parte antes referida sobre el alcance y extensión de los fallos judiciales que cita, así como también sobre la titularidad del dominio de los bienes en cuestión en el presente caso, el derecho de ofrecer y aportar pruebas, el derecho de participar activamente en la evacuación o práctica de las pruebas (lo cual incluye el derecho de formular preguntas y oponerse a preguntas de los otros sujetos procesales e interponer recursos contra las decisiones tomadas en la fase de evacuación de las pruebas) y el derecho de impugnar las resoluciones judiciales que se dicten con respecto al tema en cuestión.

Así las cosas, al tratarse de argumentos relativos al fondo del asunto y no propiamente a la integración del SINAC como parte procesal a la litis, se rechazan dichos argumentos de oposición, y mas bien dichas afirmaciones son aspectos que deberán ser dilucidados una vez integrada correctamente la litis en este caso con todas las partes involucradas. Finalmente, la representación estatal actora se refirió respecto de la audiencia formulada respecto de este tema en escrito visible a imágenes 204 a 206 del expediente digital, en que, en síntesis, se opone a las manifestaciones realizadas por la sucesión respecto la demanda señalada por dicha parte en su gestión, e indica que resulta necesario la integración del SINAC con fundamento en lo siguiente: "(...) Consideramos pertinente y necesario integrar la litis con el Sistema Nacional de Areas de Conservación, con fundamento en que corresponde a ese Sistema la Administración de la franja fronteriza norte, así como lo correspondiente al Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte.

Como hemos indicado, los terrenos en litigio, por su naturaleza, constituyen bienes demaniales que pertenecen al Patrimonio Natural del Estado, cuya competencia recae en el SINAC. Por lo anterior y a fin de evitar futuras nulidades es procedente la integración de la litis con este órgano." (ver imagen 204 del expediente digital). Al ser la posición de la representación estatal favorable a la integración del SINAC que aquí se ordena, no resulta necesario referirse en forma adicional a sus argumentos antes indicados. Así las cosas, en el tanto en esta litis se pretende el reconocimiento, declaración, modificación o anulación de derechos relacionados con áreas que se indica integran el Patrimonio Natural del Estado, resulta no solo prudente sino también necesario, para cumplir con el debido proceso y evitar eventuales nulidades en la tramitación, integrar al Sistema Nacional de Áreas de Conservación (SINAC) en condición de litisconsorte activo necesario.

POR TANTO

Se declara la existencia de una falta de integración de la litis consorcio activa necesaria, apreciada de oficio, dentro de la presente causa promovida por el ESTADO en contra de [Nombre 001] Y SUCESION DE [Nombre 002]; se ordena integrar al Sistema Nacional de Áreas de Conservación (SINAC) en condición de litisconsorte activo necesario. Contra lo resuelto proceden las acciones prescritas por el CPCA.- NOTIFÍQUESE. Dr. José Alvaro López Camacho. Juez. JLOPEZCAM ???????????????
