IMPROPER HIERARCHICAL APPEAL (Municipal) PLAINTIFF:

MUNICIPALIDAD DE MORA No. N° 2023004037 ADMINISTRATIVE AND CIVIL COURT OF THE TREASURY, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at dieciseis horas con diecinueve minutos del dos de Octubre del dos mil ventitres.- This Court, acting as NON-HIERARCHICAL REVIEWER OF LEGALITY, hears the appeal filed by INMOBILIARIA PACACUA S.A, represented by GRACIELA CRUZ QUESADA, in her capacity as attorney-in-fact with full powers and no monetary limitation (apoderada generalísima sin límite de suma), against decision AMR-180-2021 of catorce horas del trece de diciembre del dos mil veintiuno, issued by the Office of the Mayor of Mora.
WHEREAS
SECOND: In decision RU-21-888 of 09 de setiembre del dos mil veintiuno, the Municipalidad de Mora denied the business license (licencia comercial), finding that the property is located in an area where only urban use is permitted and, therefore, keeping animals could be incompatible with the predominant use (image 89 of the court record downloaded in ascending order).
THIRD: In a filing dated 17 de setiembre del 2021, the company INMOBILIARIA PACACUA S.A filed a motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio), asserting that longstanding structures on the land would permit the COV and that, consequently, its right, which had already been recognized in prior years, was being disregarded (image 64 of the court record downloaded in ascending order).
FOURTH: In decision DDCU-096-2021 of doce horas del siete de octubre del dos mil veintiuno, the Department of Urban Development and Control of the Municipalidad de Mora denied the motion for reconsideration and referred the matter to the Office of the Mayor for a ruling on the subsidiary appeal filed (image 61 of the court record downloaded in ascending order).
FIFTH: In decision AMR-180-2021 of catorce horas del trece de diciembre del dos mil veintiuno, the Municipality denied the appeal filed (image 39 of the court record downloaded in ascending order).
SIXTH: Once again dissatisfied, the appellant challenged decision AMR-180-2021 on the ground that, in its view, it lacked adequate reasoning (fundamentación) (image 45 of the court record downloaded in ascending order).
SEVENTH: The motion for reconsideration was denied in decision AMR-028-2022 of ocho horas treinta minutos del veinticuatro de febrero del dos mil veintidós; the Office of the Mayor dismissed the motion for reconsideration and summoned the appellant to appear before the higher authority so that the appeal could be heard (image 53 of the court record downloaded in ascending order).
FIRST: The property identified by cadastral survey plan (plano catastrado) N. SJ-278825-2006 had a land-use permit (permiso de uso de suelo) for segregation (segregación), pursuant to the land-use certificate (certificación de uso de suelo) dated 13 de febrero del 2006 (image 69 of the court record downloaded in ascending order).
SECOND: The land-use certification (constancia de uso de suelo) dated 13 de febrero del 2006 states that condominium construction is permitted, provided that the stipulated conditions are met and the various permits are requested in accordance with the applicable laws (image 69 of the court record downloaded in ascending order).
THIRD: In official letter DSIII-1284 of 6 de setiembre del 1995, the Ministry of Health raised no objection to the application to build horse stables, provided that all types of nuisance generated by the activity itself were contained and that construction plans were submitted to the construction-permit review committee (image 75 of the court record downloaded in ascending order).
FOURTH: In official letter UR-1285 of 28 de agosto de 1995, INVU stated that the property identified by cadastral survey plan SJ-278825-77 is located in an agricultural zone; therefore, its use was conditional and subject to all potential nuisances being contained within the property (image 77 of the court record downloaded in ascending order).
SOLE FACT: That the appellant had a construction permit approved by the Municipalidad de Mora to build the stables referred to in the record.
By contrast, in an improper hierarchical appeal (recurso jerárquico impropio), where no hierarchical relationship exists between the authority issuing the act and the appellate body, only matters strictly concerning legality may be examined; that is, whether the administrative act under review complies with the legal system. Matters concerning compliance, interpretation, resolution, and, in general, issues relating to whether licenses may be granted once all requirements have been met, fall outside the review that the improper hierarchical authority may conduct. In this particular case, the central issue is that, according to the appellant, it has held a vested right since 1995 and therefore its current application concerning the keeping of horses cannot be denied. With the foregoing understood, it is essential to cite rulings of this Court concerning the general scope of a land-use certificate (certificado de uso de suelo).
In that regard, this Section has stated: “[...] a land-use certificate is an administrative act (acto administrativo) that, by its nature, directly affects the legal sphere of the administered party (administrado) and is therefore capable of producing effects independently, because its content may state the existence of limitations on the exercise of the attributes of property rights, pursuant to current land-use regulations and the environmental regulatory framework, thereby permitting or preventing subsequent decisions by private parties, including investments involving construction or business-license impacts. The position that this type of administrative act is merely declaratory and therefore does not affect the legal sphere of the administered party has been superseded by case law, both from the Constitutional Chamber and the First Chamber. This position is fully shared by this Court acting as an improper hierarchical authority and has been expressed by it for several years, since such a certificate is now regarded as a true act that grants or limits subjective rights (derechos subjetivos) [...].” Emphasis added.

Likewise, the First Chamber of the Court has issued rulings on the matter: “[...] it must be noted that said administrative conduct—the land-use certificate—records the use to which, under land-use regulations, a particular parcel of land may be put, and this constitutes its scope. Its effects concern real property and therefore indirectly affect the legal sphere of the owner of the property.” (Decision 00191 - 2016 of once horas diez minutos del tres de marzo del dos mil dieciséis). Emphasis added. To the same effect, see decision 19060-2020 of nueve horas veinte minutos del tres de junio del dos mil veinte of the First Chamber of the Supreme Court of Justice: “[...] that certificate states the use that may be made of real property pursuant to land-use regulations. Furthermore, its effects relate to a parcel of land and indirectly affect the legal sphere of the property owner. This is consistent with Article One of the Urban Planning Law (Ley de Planificación Urbana, LPU), insofar as land use ‘…is the utilization of land, of the physical structure situated or incorporated thereon, or of both, with regard to the class, form, or intensity of such utilization […]’.” Emphasis added.
First, it must be considered that the record contains no building permit (permiso de construcción), contrary to the applicant’s erroneous understanding, much less one for horse stables. The appellant cannot equate the term land-use certificate with a building permit, since they are two different legal concepts (figuras jurídicas), and one is not contingent upon the other; rather, the land-use certificate is one of the requirements for the issuance of a building permit, which has been defined as the administrative application undertaken after obtaining Urban Approval (Visado Urbano), through which the Municipality approves and authorizes any owner or the owner’s legal representative to carry out building or urban-development works on a property, provided that the requirements of the corresponding application have been met. In this specific case, that building permit is absent, and this, together with the literal wording of the land-use certificate—which, as indicated, was for subdivision and was contingent upon compliance with and applications for the corresponding permits—clearly supports the conclusion that construction of the stables was not permitted either.
If the applicant carried out that construction, it was certainly done in violation of the regulations, since, it bears repeating, the construction of stables was never authorized (and, if it was, the necessary building permits were not submitted). This is therefore decisive in rejecting the appellant’s argument and affirming the decision of the Alcaldía Municipal, insofar as the appellant is not protected by a subjective right but merely has an expectation of a right (expectativa de derecho). It must be taken into account that even in official letter DSIII-1284 del 6 de setiembre del 1995, although the Ministerio de Salud did not object to the application to build horse stables, that same official letter made the application contingent upon containing within the property all types of nuisances generated by the activity itself and upon the submission of construction plans to the building-permit review commission; however, it did not authorize construction at any time because, evidently, the Ministerio de Salud could not issue that permit.
A similar situation arose with official letter UR-1285 del 28 de agosto de 1995, in which INVU stated that cadastral plan property SJ-278825-77 was located in an agricultural zone, meaning that its use was conditional and subject to all potential nuisances being contained within the property. Therefore, if horses are already being kept and stables have already been constructed, this does not appear to be the result of the legal system’s response to the appellant’s construction applications, but rather of conduct undertaken without any legal basis whatsoever. Although the appellant seeks to establish that the stables have operated since 1993, the date on which the activities began is irrelevant, since the central issue is the building permit for those stables, which—again—is absent. Accordingly, what is being called into question is not even the location of the land, as has erroneously been argued, but rather the history of the property at issue, which does not support the conclusion that the appellant was in fact protected by a subjective right requiring respect notwithstanding subsequent amendments to the 2001 Master Plan Zoning Regulations (Reglamento de Zonificación del Plan Regulador).
Consequently, if that is so, it means that when land-use application RU-21-888 was denied, the proper course was indeed to apply the regulations currently in force, under which the property is categorized as being in an urban zone; therefore, keeping animals of the type contemplated in the application is incompatible with that zoning, as the Municipalidad resolved. Thus, no failure to provide reasons (falta de fundamentación) on the part of the Municipalidad de Mora is apparent. Quite the contrary, the Municipalidad has acted diligently and set forth its determination conclusively, a determination with which this judge agrees because it is consistent with the facts that occurred. Nor is there any indication that matters raised by the appellant were left unresolved. Quite the contrary, the Municipalidad addresses subjective rights and the location of the property and consequently determines that the request must be denied, precisely because the stables lack building permits.
Although the party seeks to maintain that no new construction will be undertaken and that the matter concerns only the stables already built, the fact remains that those structures did not have the corresponding permits. Accordingly, there is no alternative but to affirm the decision of the Municipalidad de Mora and deny the appeal filed.
POR TANTO
In accordance with the foregoing sections, the appeal filed by INMOBILIARIA PACACUA S.A against resolution AMR-180-2021 de las catorce horas del trece de diciembre del dos mil veintiuno, issued by the Alcaldía Municipal de Mora, is hereby DENIED. Consequently, the appealed resolution is AFFIRMED. The parties may obtain a complete copy containing both the administrative case file forwarded by the Corporación Municipal and all documents comprising this appeal proceeding. SO NOTIFIED. LICDA. MUNICIPALIDAD DE MORA Nº N° 2023004037 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las dieciseis horas con diecinueve minutos del dos de Octubre del dos mil ventitres.- Conoce este Tribunal, como CONTRALOR NO JERÁRQUICO DE LEGALIDAD, del recurso de apelación de apelación interpuesto por INMOBILIARIA PACACUA S.A, representada por GRACIELA CRUZ QUESADA , en condición de apoderada generalísima sin límite de suma, en contra de la resolución AMR-180-2021 de las catorce horas del trece de diciembre del dos mil veintiuno dictada por la Alcaldía Municipal de Mora.
CONSIDERANDO
SEGUNDO: En resolución RU-21-888 del 09 de setiembre del dos mil veintiuno la Municipalidad de Mora rechazó la licencia comercial al considerar que la propiedad se ubica en zona donde solamente se permite el uso urbano, por lo que la tenencia de animales podría provocar incompatibilidad con el uso predominante (imagen 89 del expediente judicial descargado de forma ascendente).
TERCERO: En escrito del 17 de setiembre del 2021, la empresa INMOBILIARIA PACACUA S.A, interpuso recurso de revocatoria con apelación en subsidio al considerar que en el terreno hay construcciones de antaño que permitirían el COV y por ello, se estaría dejando de lado su derecho ya considerado desde años anteriores (imagen 64 del expediente judicial descargado de forma ascendente).
CUARTO: En resolución DDCU-096-2021 de las doce horas del siete de octubre del dos mil veintiuno, el Departamento de Desarrollo y Control Urbano, de la Municipalidad de Mora, rechazó el recurso de revocatoria y trasladó a la Alcaldía a fin de que se pronunciara sobre la apelación subsidiaria interpuesta (imagen 61 del expediente judicial descargado de forma ascendente).
QUINTO: En resolución AMR-180-2021 de las catorce horas del trece de diciembre del dos mil veintiuno, la Municipalidad rechazó el recurso de apelación interpuesto (imagen 39 del expediente judicial descargado de forma ascendente).
SEXTO: Inconforme nuevamente, el recurrente impugnó la resolución AMR-180-2021, porque a su criterio hay una falta de fundamentación (imagen 45 del expediente judicial descargado de forma ascendente).
SÉTIMO: El recurso de revocatoria fue rechazado en resolución AMR-028-2022 de las ocho horas treinta minutos del veinticuatro de febrero del dos mil veintidós la Alcaldía, declaró sin lugar el recurso de revocatoria y emplazó al superior con la finalidad de que se conociera la apelación (imagen 53 del expediente judicial descargado de forma ascendente).
PRIMERO: La propiedad plano catastrado N. SJ-278825-2006, contaba con permiso de uso de suelo para segregación según certificación de uso de suelo de fecha 13 de febrero del 2006 (imagen 69 del expediente judicial descargado de forma ascendente).
SEGUNDO: La constancia de uso de suelo de fecha 13 de febrero del 2006 señala a la construcción de condominio como permitida, siempre que se cumplan las condiciones estipuladas y , se soliciten los diversos permisos de conformidad con las distintas leyes (imagen 69 del expediente judicial descargado de forma ascendente).
TERCERO: En oficio DSIII-1284 del 6 de setiembre del 1995, el Ministerio de Salud no objetó la solicitud para construir cuadras de caballos, siempre y cuando se confinara todo tipo de molestias generadas por la actividad misma y a la presentación de planos constructivos ante la comisión revisora de permisos de construcción (imagen 75 del expediente judicial descargado de forma ascendente).
CUARTO: En oficio UR-1285 del 28 de agosto de 1995, el INVU señaló que la propiedad plano catastrado SJ-278825-77, se ubica en zona agrícola por lo que su uso era condicional y estaba sujeta a que todas las posible molestias sean confinadas dentro de la propiedad (imagen 77 del expediente judicial descargado de forma ascendente).
ÚNICO: Que la recurrente contara con permiso de construcción aprobado por la Municipalidad de Mora para construir las caballerizas referidas en autos.
Por el contrario, en el recurso jerárquico impropio, (cuando no existe relación de jerarquía entre quien dicta el acto y el órgano de alzada), sólo cabe examinar aspectos propiamente de legalidad; sea, si el acto administrativo objeto de examen se ajusta o no al ordenamiento jurídico. Escapa al examen que puede realizar el jerarca impropio, lo relativo al cumplimiento, interpretación, resolución, y en general las cuestiones referentes a la posibilidad de otorgar licencias al haberse cumplido todos los requisitos. En el caso en particular, el objeto central es que a criterio de la recurrente, tienen un derecho adquirido desde el año 1995, por lo que no puede denegarse ahora la solicitud que plantea referente a la tenencia de caballos. Entendido lo anterior, resulta vital traer a colación pronunciamientos de este Tribunal en relación a los alcances generales del certificado uso de suelo. Al respecto, esta Sección ha señalado: "[...] el certificado de uso de suelo es un acto administrativo que, por su naturaleza, incide directamente sobre la esfera jurídica del administrado, de modo que es capaz de surtir efectos de manera independiente, puesto que su contenido puede enunciar la existencia de limitaciones al ejercicio de los atributos del derecho propiedad, en aplicación de las regulaciones urbanísticas y el régimen ambiental vigente, que permite o impide la toma de decisiones posteriores por parte de los particulares, incluyendo inversiones de impacto de tipo constructivo o de patentes.
La tesis que sostenía que este tipo de acto administrativo es meramente declarativo y por ende, no incide en la esfera jurídica del administrado, se encuentra jurisprudencialmente superada, tanto por la Sala Constitucional como por la Sala Primera, criterio que es plenamente compartido por este Tribunal de jerarquía impropia y así se ha venido expresando desde hace varios años atrás, pues se le considera hoy día un verdadero acto que otorga o limita derechos subjetivos [...]". De igual manera, la Sala Primera de la corte, ha emitido pronunciamientos al respecto: "[...] debe observarse que dicha conducta administrativa –el certificado de uso de suelo- hace constar el uso al que, de acuerdo con la normativa urbanística, se puede destinar un determinado terreno, siendo este su alcance. Sus efectos se dan respecto de un inmueble, y por lo tanto, y en forma mediata, en la esfera jurídica del titular del bien." (Resolución 00191 - 2016 de las once horas diez minutos del tres de marzo del dos mil dieciséis). Lo resaltado es propio. En igual sentido, puede verse resolución 19060-2020 de las nueve horas veinte minutos del tres de junio del dos mil veinte de la Sala Primera de la Corte Suprema de Justicia: "[...] en dicho certificado se consigna el uso que puede darse a un inmueble de conformidad con las normas urbanísticas. Además, sus efectos se encuentran referidos a un terreno y se producen de forma mediata en la esfera jurídica del propietario del bien. Esto resulta conteste con lo regulado en el artículo primero de la Ley de Planificación Urbana (LPU) en cuanto a que el uso del suelo (tierra) “…es la utilización de un terreno, de la estructura física asentada o incorporada a él, o de ambos casos, en cuanto a clase, forma o intensidad de su aprovechamiento […]”.Lo resaltado es propio.
En primer lugar debe considerarse que no consta en autos un permiso de construcción, tal y como erróneamente lo entiende la gestionante, y mucho menos uno sobre cuadras de caballos. No puede la recurrente equiparar el termino de constancia de uso de suelo a permiso de construcción, puesto que se trata de dos figuras jurídicas diferentes,y una no está supeditada a la otra, sino que más bien, el certificado de uso de suelo constituye uno de los requisitos para que se proceda a otorgar un permiso de construcción, figura que se ha definido como la gestión administrativa posterior a la obtención del Visado Urbano, en el que la Municipalidad aprueba y autoriza a todo propietario o su representante legal para realizar obras de edificación o urbanización dentro de una propiedad, siempre y cuando hubiere cumplido con los requerimientos de la solicitud respectivo; y en el caso concreto ese permiso de construcción se hecha de menos, y en lazado a la literalidad del certificado de uso de suelo (el cual como se indicó lo era para la segregación y supeditado al cumplimiento y solicitudes de los permisos respectivo), permiten concluir con claridad que, tampoco era posible la construcción de las caballerizas, y si la gestionante lo realizó, ciertamente se hizo en desapego a la normativa, puesto que se reitera en ningún momento se autorizó (y de ser diferente no se aportó los permisos de construcción necesarios) la construcción de caballerizas, aspecto determinante entonces para desechar la tesis de la recurrente, y confirmar lo desarrollado por la Alcaldía Municipal, en el tanto, no hay un derecho subjetivo que cobije a la recurrente, sino una expectativa de derecho.
Debe tomarse en cuenta que incluso el oficio DSIII-1284 del 6 de setiembre del 1995, el Ministerio de Salud si bien no objetó la solicitud para construir cuadras de caballos, el mismo oficio supeditaba la gestión a que se confinara todo tipo de molestias generadas por la actividad misma y a la presentación de planos constructivos ante la comisión revisora de permisos de construcción, pero en ningún momento autorizó la construcción, porque evidentemente, ese permiso no podía ser otorgado por el Ministerio de Salud. Situación similar acontece con el oficio UR-1285 del 28 de agosto de 1995, donde el INVU señaló que la propiedad plano catastrado SJ-278825-77, se ubica en zona agrícola por lo que su uso era condicional y estaba sujeta a que todas las posible molestias sean confinada dentro de la propiedad. Por ello, si ya existe una tenencia de caballos y construcción de caballerizas, la misma no parece ser consecuencia de la respuesta del aparato jurídico a las solicitudes de construcción de la recurrente, sino a un actuar, pero sin fundamento alguno; y si bien se pretende hacer ver que las mismas operan desde el año 1993, la fecha de inicio de las actividades resulta irrelevante, puesto que lo medular lo es el permiso de construcción de esas caballerizas, y el cual, -nuevamente se reitera-, se hecha de menos.
De esta manera, lo que se pone en tela de duda, no es ni siquiera la ubicación del terreno, como erróneamente se ha venido argumentando, sino que los antecedentes de la finca en cuestión que no permiten concluir, que efectivamente le cobijara a la recurrente un derecho subjetivo que amerite ser respetado por reformas posteriores al Reglamento de Zonificación del Plan Regulador del año 2001. Consecuentemente, si eso es así, quiere decir que al momento de rechazar la gestión de uso de suelo RU-21-888, efectivamente lo procedente era utilizar la normativa vigente en la actualidad, la cual categoriza a la propiedad en zona urbana, ergo, es incompatible la tenencia animales de la índole que se gestiona; tal y como resolvió la Municipalidad. De esa forma, no se denota una falta de fundamentación por parte de la Municipalidad de Mora, todo lo contrario, la Municipalidad ha sido diligente y ha desarrollado el criterio de forma contundente, criterio que esta juzgadora comparte, pues es acorde a la realidad acontecida.
Tampoco se evidencia que se hayan dejado de lado aspectos por resolver y que hayan sido cuestionados por la recurrente, todo lo contrario, la Municipalidad desarrolla lo referente a los derechos subjetivos, la ubicación de la propiedad y consecuentemente determina el rechazo de lo solicitado, precisamente por la ausencia de los permisos de construcción de las caballerizas. Y si bien es cierto, la parte pretende sostener que no se realizará ninguna nueva construcción, sino que todo versa sobre las caballerizas ya construídas, lo cierto es que tales edificaciones no contaban con los permisos respectivos. Siendo así, no queda más que confirmar lo resuelto por la Municipalidad de Mora y rechazar el recurso presentado.
POR TANTO
De conformidad con lo expuesto en los apartados precedentes se declara SIN LUGAR el recurso de apelación interpuesto por INMOBILIARIA PACACUA S.A, en contra de la resolución AMR-180-2021 de las catorce horas del trece de diciembre del dos mil veintiuno dictada por la Alcaldía Municipal de Mora. Consecuentemente SE CONFIRMA la resolución recurrida. Queda a disposición de las partes obtener una copia integral que contiene tanto el expediente administrativo remitido por la Corporación Municipal así como la totalidad de las piezas que conforman la presente alzada.
