JUDICIARY JUVENILE CRIMINAL JUDGMENT APPEALS COURT Decision: 2023-0044 Case File: 16-001389-0414-PE (5) JUVENILE CRIMINAL JUDGMENT APPEALS COURT. Second Judicial Circuit of San José. (Acting in the capacity of the Guanacaste Criminal Judgment Appeals Court, Santa Cruz seat.) Goicoechea, at ten o’clock on treinta de enero de dos mil veintitrés.
APPEAL filed in the present proceedings brought against [Nombre 001], [...], for the offense of ENCROACHMENT UPON A CONSERVATION OR PROTECTION AREA (INVASIÓN A UN ÁREA DE CONSERVACIÓN O PROTECCIÓN), to the detriment of NATURAL RESOURCES. Judges Jorge A. Camacho Morales, Gustavo A. Jiménez Madrigal, and Flory Chaves Zárate participated in deciding the appeal. Attorney Jorge Enrique Porras Leiva, private defense counsel for the accused; Attorney Victor Hugo Castro Cartín, of Banco Popular; Attorney Zaray Chavarría Prado, Criminal State Counsel; and Attorney Luis Diego Quesada Canales, representing the Public Prosecutor’s Office, entered appearances before this Court.
RESULTS:
I.By judgment number 107-2022, issued at seven thirty on primero de junio del dos mil veintidós, the Trial Court of the Second Judicial Circuit of Guanacaste, Nicoya, ruled: “POR TANTO: Once the judgment becomes final, and pursuant to Article 140 of the Code of Criminal Procedure, Article 103 of the Criminal Code, and Articles 33, 34, and 58(a) and (b) of the Ley Forestal, it is ordered that the affected protection zone (zona de protección) be restored to its original condition. It is likewise ordered that the structures and buildings located within the protection area of the property registered in the Guanacaste Registry District under record number [Valor 003], located in [...], owned by [Nombre 032] Sociedad Anónima, be demolished in accordance with the findings stated in the Supplemental Expert Report DCF:2018-00896-ING, prepared by the Department of Forensic Sciences, Forensic Engineering Section, Organismo de Investigación Judicial, because they encroach upon a protection zone. [Nombre 001] is granted a period of two months after the judgment becomes final to demolish the structures built within the protection area of the Río Chimpanzo, bearing the costs of demolition and removal of materials from the affected site.
The Ministerio de Ambiente, Energía y Telecomunicaciones, Sistema Nacional de Áreas de Conservación, Área de Conservación Tempisque, is ordered to conduct an inspection and submit a report to verify compliance with the orders contained in this judgment. [Nombre 001] is advised that compliance with this ruling is mandatory and that proceedings may be brought against him for the offense of disobedience of authority (Desobediencia a la autoridad) in the event of noncompliance. This ruling shall be communicated to the Municipalidad de Nicoya, Guanacaste. The reading of the full judgment is scheduled for sixteen hours on 08 de junio del 2022. NOTICE SHALL BE GIVEN BY READING. Olman Carballo Badilla. Judge of the Nicoya Trial Court. (sic, fol. 301 verso and fol. 302).”
II.Attorney Jorge Enrique Porras Leiva, private defense counsel for the accused, and Attorney Victor Hugo Castro Cartín, of Banco Popular, filed appeals against the foregoing ruling.
III.After the corresponding deliberation was conducted in accordance with Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal.
Appellate Judge Camacho Morales drafts the decision; and,
CONSIDERING:
I.By final agreement adopted by the Full Court at session number 22-2022 of dieciséis de mayo de dos mil veintidós, the jurisdiction of the Juvenile Criminal Judgment Appeals Court was expanded to include ordinary criminal matters falling within the jurisdiction of the Guanacaste Criminal Judgment Appeals Court, Santa Cruz seat. The Full Court extended that expanded jurisdiction at session 65-2022, held on 19 de noviembre de 2022, Article XVII, through 11 de julio de 2023. Accordingly, this Appeals Chamber has jurisdiction to hear and decide appeals from judgments issued within the adult criminal jurisdiction of the province of Guanacaste.
As recorded at folio 374, an oral hearing was held on 14 de setiembre de 2022 before the Guanacaste Criminal Judgment Appeals Court, Santa Cruz seat, which at that time was composed of Judges José Manuel Cisneros Mujica, Rodrigo Obando Santamaría, and Brisa Campbel Argüello. At that hearing, all parties presented their arguments, which were already set forth in writing, except those of the prosecution, and no evidence was received. By virtue of the allocation of jurisdiction explained in the preceding consideration and ordered by the Full Court of the Poder Judicial, the case file was transferred to this Court. This causes no prejudice whatsoever to the parties, as the Sala Constitucional has held in such cases: “...it is constitutionally valid for judges other than those who participated in the hearing to take part in deciding cases in which no evidence is received orally during cassation proceedings or oral hearings, or in which the parties’ arguments are already set forth in writing and nothing new is submitted, if and only if they are capable of doing so and justified reasons exist—which must be placed on the record—preventing those who attended the oral hearing from meeting promptly to examine and decide the matter...” (Sala Constitucional, N.º 6681 at 15:30 hours on 10 de diciembre de 1996, Nº17553 at 12:23 h. on 30 de noviembre de 2007, and, from the same Sala Constitucional, N.º 6880 at 15:05 hrs. on 22 de mayo de 2013).
Accordingly, because no evidence was received at the oral hearing and the grounds stated in the appellate brief were not expanded, except through the response of the Public Prosecutor’s Office, the change in the composition of the Court causes no prejudice whatsoever to the parties. In any event, this Chamber reviewed the contents of the hearing, transcribed in the decision the statements made by all parties, and considered them when issuing this judgment.
III.APPEAL FILED BY JORGE ENRIQUE PORRAS LEIVA, COUNSEL FOR THE ACCUSED [Nombre 001] AND SPECIAL JUDICIAL ATTORNEY-IN-FACT FOR [Nombre 032] S.A., AGAINST JUDGMENT 107-2022 ISSUED AT 07:30 HOURS ON 1 DE JULIO DE 2022 BY THE CRIMINAL COURT OF THE SECOND JUDICIAL CIRCUIT OF GUANACASTE, NICOYA SEAT.
This diminished the judge’s ability to follow the evidence, particularly because, between one continued hearing and the next, the judge participated in many other trials. This may be verified by requesting a list of the trials assigned to Judge Olman Carballo Badilla, which would establish that “it is humanly impossible to retain an accurate recollection of what occurred at trial when issuing the judgment, leading to glaring errors, such as not knowing the name of the accused who testified at trial, since according to the judgment (page 9), the accused who testified was [Nombre 007]. Likewise, it is incomprehensible how the judgment could order the demolition of a building under the current Ley Forestal when the evidentiary record itself, including official letter ACT-OSRN-605-2018 at folio 60, establishes that the existing construction had permits because, at the time of the events—the original construction—the Ley Forestal provided for a protection zone of 5 meters.
This is consistent with the testimony of JOSÉ ELÍAS BENAVIDES, who stated that the construction at the site had already existed for several years, a circumstance substantiated by the two construction-permit certifications that we offered during the trial and that were admitted, but that the judge neglected to describe and analyze. In those certifications, the Municipalidad de Nicoya states that construction permits had previously been granted for the property, evidently because the construction complied with the Ley Forestal in effect at the time. Such omissions are characteristic of an unfocused and careless judge who, compounded by his inexperience as a criminal judge, being a Judge 1 with barely 6 months of experience as a criminal trial judge—and therefore unfit—was unable to withstand the passage of time and ultimately issued an unlawful judgment.” (folios 305 to 306).
(ii) The documents admitted as evidence for a more informed decision (prueba para mejor resolver) (folio 244) were neither analyzed nor described. Had they been considered together with the remaining evidence, the conclusion would have been that the construction attributed to the accused included buildings erected in accordance with a Ley Forestal predating the one currently in force, which imposed a five-meter restriction for the river protection area; this was not analyzed because of the aforementioned omission.
(ii) The Judge oversimplified the foregoing by stating that the defendant (encartado) was the perpetrator of the offense of encroachment upon a protected area (área de protección), and then cited a judgment of the Sala Tercera concerning a case with different circumstances, without explaining how that judgment affected the resolution of the present case. The Judge states that [Nombre 001] signed records (folio 41), but it is unknown which records he signed or how the Judge reached that conclusion. (iii) The finding of the accused’s liability was derived from the testimony of Josué Ruiz, who is a business partner of [Nombre 011], the accused’s brother, with whom the accused has a serious estrangement due to family disputes; in other words, Josué, knowing that he was handling matters involving his business partner’s enemy (they have a business together; see page 13 of the judgment), did not recuse himself from doing so.
The other witness who confirmed that [Nombre 001] was the perpetrator was [Nombre 027], whom the Judge treated as a suspect witness (testigo sospechoso) and who, according to his testimony (folio 18 of the judgment), stated that, on the date of the events, title to the property was registered to Banco Popular; indeed, in setiembre 2014, he filed a property declaration with the Municipalidad de Nicoya and stated under oath that the property belonged to the entity he represented. Thus, without any explanation, the Judge believed these “unconvincing” witnesses and convicted the party represented by counsel. (iv) In the indictment, [Nombre 001] was accused of encroaching upon a protected area of approximately 230 square meters, but the witness José Elías Benavides stated that the portion encroaching upon the protected area and not constructed in accordance with the Law (with a 5-meter protection zone (zona de protección)) was a roof overhang that was not attached to the ground within the prohibited area.
This is consistent with report ACT-OSRN-122-14 at folio 45 of the administrative case file (expediente administrativo), which was admitted as evidence that, on 6 de agosto de 2014, the same official recommended authorizing construction at the site after confirming that there was no encroachment upon the river’s protected area. It follows from the foregoing that, one month after the events occurred, as of 14 de agosto de 2014, [Nombre 001] had not committed any offense, and there is no evidence contradicting the official, whose statement there is no reason to doubt. The Judge failed to analyze this, and it is unclear why he concluded that the accused committed the offense on the date of the events, particularly since the subsequent inspection conducted to verify the events took place on 30 de enero de 2015, more than 6 months after the first inspection. Accordingly, if the events did occur, they occurred between 6 de agosto de 2014 and 30 de enero de 2015, and not as the Judge found, leaving evidence unanalyzed.
(v) On the date of the events, Banco Popular held title to the property, according to the property declaration submitted by [Nombre 027], and the property was not registered in the name of [Nombre 032] S. A. until 9 de setiembre de 2014 (folio 30); the Judge questioned none of this. (vi) The trial judge also failed to analyze the loan file (expediente crediticio) precisely with respect to the fact that, when the sale to [Nombre 032] S. A. occurred, there was already a building on the property that remains there today, made of concrete and with its perimeter enclosed by concrete blocks and wire mesh; in other words, the structure that the accused is alleged to have used to encroach upon the area had already been built when Banco Popular sold the property to it. In the appraisal reports (peritajes de avalúo), the Judge did not analyze the description of the property at the time of the sale, the photographs in the case file, or the property description; instead, he analyzed only a forensic expert report (peritaje forense) that assessed the perimeter of the area under a law enacted after the buildings were constructed.
It is inconsistent to conclude that the preexisting construction must be demolished, and the trial judge should have distinguished between what was to be demolished and what was not because it had the appropriate permits, as shown by construction-permit certification 100-07-2021 at folios 245 to 248 of the main case file (expediente principal). A review of the loan file is sufficient to determine that [Nombre 032] S. A. is the only party that was deceived, because it purchased a property without knowing of its latent defects (vicios ocultos) relating to the protected-area restrictions.
RELIEF SOUGHT (PRETENSIÓN): Grant the appeal, vacate the judgment, and remand the case for new proceedings.
At an oral hearing held before the Guanacaste Judgment Appeals Court beginning at 10:05 on 14 de setiembre de 2002, attorney [Nombre 001] orally presented the grounds for the appeal. In this regard, he stated: The judgment contains incurable defects that prevent it from becoming effective. The first argument is the violation of the principle of continuity and concentration of the trial (principio de continuidad y concentración del debate). The trial began on 29 de abril de 2022, and the judgment was not issued until primero de junio de 2022; more than one month elapsed between its beginning and conclusion. A trial with 3 witnesses required 5 hearings, which occurred outside the procedural framework established by the Code of Criminal Procedure (Código Procesal Penal). It was not adjourned for reasons established by the Legal System (Ordenamiento Jurídico), but because of scheduling problems; all of the continuation hearings were scheduled and began later than the appointed times because single-judge trials with the same judge were scheduled at the same time.
The judge would adjourn the trial to continue another one or to begin a new one, even though continuation of this trial had been scheduled for the entire day. This prevented the Court from being able to know what was happening. This reached the point that one of the grounds for appeal concerned the omission of evidence (preterición de prueba) that had been offered and admitted but that the judge neglected to analyze in the judgment, evidence that fundamentally affected the scope of the charges (marco acusatorio). Specifically, documentary evidence (prueba documental) was offered showing that Banco Popular held formal possession (posesión formal) of the land because it was the registered owner at the time the events occurred. That evidence appeared in the municipal case file, was admitted, and then was not analyzed, leaving the judgment devoid of any discussion of the Defense’s strategic argument that Mr. [Nombre 001] could not have perpetrated the acts because he was not the registered owner and because, through a sworn real-property declaration issued after the events occurred, Banco stated that the property belonged to it.
This was caused by the effect of the lack of concentration in the trial and when assessing the evidence submitted for scrutiny. The judgment is also challenged because the judge incorrectly assessed the evidence that was admitted and that he did analyze, since he failed to examine why, on the date when the events allegedly occurred, a MINAE official conducted an inspection and stated in report ACT-OSRN-122-14, appearing at folio 45, that there was no impact or construction on the land involving encroachment upon a specified area. This leaves the date of the charged acts uncertain because, according to the accusation, they occurred in 2014, yet in the first half of julio the MINAE official determined that there was no impact, which was not found until one year later. In other words, if the events did occur, they occurred after MINAE’s involvement and up to one year later, on the date of the second assessment; therefore, they could not have occurred in the first half of julio del 2014.
That date falls outside the charging instrument (pieza acusatoria); in other words, these events could never have occurred in the first half of 2014, as charged and as the judge found proven, even though the documentary evidence establishes otherwise. The judge did not analyze the fact that MINAE itself establishes that there was not, and to date is not, any impact on the forest estate (patrimonio forestal) or on the protection area (área de protección) of Río Chimpazo, with the consequence that the conduct would not have caused legally cognizable harm (lesividad). With respect to restoration of the property to its original condition (restitución de las cosas a su estado original), matters that were not part of the trial were taken into account, while matters that were part of it were overlooked. When Mr. [Nombre 001] acquired that property before the events, the structure that the judge ordered demolished already existed exactly as it was; that structure had been built with permits from the Municipalidad and permits from the forestry authority (rector forestal).
It had already been built. What the judge found proven was that the construction was attributed to Mr. [Nombre 001], although it was not new construction because a wall along the property boundary had also already been built; nevertheless, when ordering demolition, the judge ordered everything demolished, including what had already been built under a forestry law that provided for a protection area of five meters rather than ten meters. The judge did not consider the 5 de mayo amendment to the Ley Forestal concerning artículo 33 bis, which permits civil works (obra civil) in the protection area to channel water and prevents effects on structures that have already been built.
RELIEF SOUGHT (PRETENSIÓN): Vacatur of the decision is requested, with an order that the matter be heard again.
IV.JOINED APPEAL FILED BY ATTORNEY VÍCTOR HUGO CASTRO CARTÍN, COUNSEL FOR CIVIL DEFENDANT BANCO POPULAR Y DE DESARROLLO COMUNAL, AGAINST JUDGMENT 107-2022 AT 07:30 ON 1 DE JULIO DE 2022, ISSUED BY THE CRIMINAL COURT OF THE SECOND JUDICIAL CIRCUIT OF GUANACASTE, NICOYA VENUE.
SOLE GROUND: Disagreement with the order to restore the property to its original condition. This ground is supported as follows: (i) Report ACT-OSRN-605-2018, appearing at folio 60, shows that, before the charged acts, a structure existed on the disputed property that had been built in accordance with the Ley Forestal then in force, which established a protection area of 5 metros from the riverbank, and that the corresponding permits had been obtained. (ii) No evidence has been submitted establishing which portion of the structures currently standing should be considered new construction or an addition, on the basis of which these proceedings were instituted. (iii) Ordering the demolition of the structures is improper and contrary to law, since demolition would be permissible only with respect to what was built on the date of the charged acts, which is materially and legally impossible to determine because there is no evidence that makes it possible to distinguish between the preexisting and new structures. (iv) Ordering the demolition of the entire structure pursuant to the current Ley Forestal causes Banco Popular substantial harm because of the resulting loss in value of the property pledged as collateral for the loan.
RELIEF SOUGHT: It is requested that the appeal be granted, that the challenged judgment be declared partially ineffective solely insofar as it ordered restoration of the property to its prior condition, and that a replacement decision be issued.
At an oral hearing held before the Guanacaste Judgment Appeals Court beginning at 10:05 hours on 14 de setiembre de 2002, attorney Castro Cartín stated that the cross-appeal (recurso de adhesión) concerned the ruling on restoration of matters to their original state (restitución de las cosas al estado original). He stated that, when that portion of the judgment was rendered, the rules of sound judicial assessment (sana crítica) were disregarded in evaluating evidence of decisive value. Restoration of matters to their prior state was ordered without determining what that prior state was. There was a property on which a particular structure existed, built in accordance with the forestry legislation in force at the time of its construction, and the events at issue here occurred subsequently, involving a building or addition separate or apart from the existing structure that, according to the prosecution’s theory, constituted the criminal activity of encroaching upon the protection area (área de protección).
The problem is that the works carried out in violation of the Ley Forestal have not been identified. Banco Popular owns an adjudicated property, namely [Valor 003], as shown in the administrative record submitted to the case file. The property had no encumbrances, was registered, and had a registered cadastral survey indicating that there was a restaurant on the property (folios 86, 90, 104, 105, 106 of the administrative record). Mr. [Nombre 001] expressed an interest in acquiring the property in its existing condition. An appraisal was conducted that contemplated financing for improvements to the existing infrastructure, such as improvements to the electrical installation, painting, and replacing part of the roof; the loan was approved on those terms, all of which appears in the administrative record. Once the loan was approved, the property was sold. The public instrument (escritura pública) documenting that the sale took place on 14 de octubre de 2014 appears at folios 159 and 179 of the main case file.
On the same day as the sale, as witness [Nombre 027] testified, Mr. [Nombre 001] took possession of the property. The purchase was made through a corporation (sociedad anónima) represented by Mr. [Nombre 001]. The testimony establishes that possession of the property was taken on the same day as the instrument or, at the latest, the following day. Up to that point, there was a property with a structure, and everything was in order. Subsequently, additions began to be made; these were detected by the Municipality, which conducted inspections and found, beginning on 21 de julio de 2014, not only work on the electrical installations and other items, but also an addition that was not included in the original plan and that was carried out without construction permits. As a result, the work was halted, and a report and sketch were prepared, appearing at folio 25 of the administrative record submitted by the Municipality, based on an inspection conducted on 24 de setiembre de 2014.
This report states that an addition, an expansion area, a new area, already existed, entirely separate from the structure that had already been built, and that this new area was, in theory, encroaching upon the protection area. On those terms, and under the theory that the conduct could be entirely criminal, the administrative record contains the decisions dated 23 de setiembre de 2014 and 17 de octubre de 2014 (other documents are cited, but they cannot be clearly understood), all of which point in the same direction: that there was an encroachment of approximately 101 square meters into a protection area, an addition that did not exist in the (inaudible). From that perspective, the information was provided to the Public Prosecutor’s Office (Ministerio Público), and the complaint states that this 101-square-meter addition did not exist in the original building. In theory, the proceedings and investigations should have focused on determining whether these additions, these new works, constituted an offense.
When the investigation began, as shown in the expert report (dictamen pericial) at folios 25 to 27, the experts were asked to determine whether the structure encroached upon a protection area—not whether the new works or the new construction did so, but whether the structure as a whole did. Based on that premise, the experts issued a report that no longer referred to 101 meters, but instead stated that there was an encroachment of approximately 240 square meters, creating a new situation and uncertainty because the area at issue in the proceedings had not been identified. The indictment (acusación), like the private complaint (querella) and the civil action (acción civil), is based on an encroachment of 240 square meters, divided into three parts: 44 square meters of sidewalk, 67 square meters of parking area, and 129 square meters of storage area. The sketch on the front and back of folio 27 shows that the line drawn by the experts extends entirely into the old structure and does not distinguish it from the new construction.
The line runs through the middle or one-third of the entire storage area. From that perspective, the facts and the structure to be demolished have not been identified. Furthermore, folios 59 and 60 contain official letter ACT-OSRN-605-2018, which is the environmental damage assessment (valoración del daño ambiental), and folio 60 states that what was built was a wall 16 meters long by 4 meters high, with a roof and steel purlin structure, encroaching upon an area of 44 square meters along the property boundary where a chain-link fence had previously stood; it also mentions that a structure already existed. The Municipality referred to 101 square meters, the Judicial Branch personnel referred to 240 square meters, and the environmental damage assessment referred to 44 square meters. The judgment was rendered against that background of uncertainty regarding the affected area. All of this was raised in closing arguments, where it was stated that there was no clear basis for rendering a judgment ordering restoration of matters to their original state in accordance with the supplemental expert report, which is the document that refers to 240 meters and considers all of the structures.
From that perspective, the order requires the demolition not only of the addition, which is what relates to the alleged criminal activity, but also of one-third of the structure that serves as collateral for the loan transaction granted in the amount of 71 million colones.
RELIEF SOUGHT (PRETENSIÓN): We request that the decision be set aside insofar as it ordered restoration of matters, and that the proceedings be remanded with respect to that issue.
The 10-day period was not exceeded between adjournments. It must be borne in mind that court calendars are overloaded and adjournments are necessary. Several witnesses were examined, including the defendant, which justified the adjournments and the trial’s duration of approximately one month. A reading of the judgment shows that not even minimal prejudice arose from the circumstances he alleges. Defense Counsel’s technique is to emphasize certain documents while disregarding the evidence as a whole, which the Court properly considered. There are not only the SINAC reports, which serve in some manner to establish the defendant’s encroachment upon the protection area. The same was indicated by the Banco Popular representative. It is clear that this occurred in 2014, which Defense Counsel identifies as a source of prejudice because, according to the indictment, the events occurred in 2014, whereas they actually occurred much later, and there is no congruence between what was charged and what was established.
An analysis of other documents confirms that the loan granted to him was intended to finance construction work on this property, and it was that construction that caused the encroachment upon the protection area of the river at issue here—an encroachment that is beyond doubt based on an assessment of the evidence as a whole. There are expert examinations. In his statement, the defendant said that the Municipality had it in for him and that he was being persecuted, but how could the Municipality not monitor the construction he was carrying out when he never applied for a permit and the work was being performed 150 meters from the Municipality? Had he applied for the permits, he would have been advised where he was required to build, instead of putting up the structures recklessly and thereby creating the problem of an encroachment encompassing three structures: the parking area, sidewalk, and storage area.
All of this was established through the testimony of municipal officials and SINAC officials, who explained that during the inspections the person in charge of the site was the defendant, who received them, sometimes reluctantly. As to restoration: Water is not an inexhaustible resource, and the area encompassing those resources is protected. Accordingly, and pursuant to topographical expert reports identifying the areas encroaching upon the 10-meter zone, the encroaching structures must be demolished. The in dubio pro natura principle authorizes the judge, if there is any doubt regarding preexisting structures, to rule in favor of nature—the river.
RELIEF SOUGHT (PRETENSIÓN): The ruling should be upheld in all respects, and both appeals should be denied. Banco Popular lacks standing (legitimación), as noted by the representative of the Procuraduría.
(iii) Municipal building permits numbers 547-2009, for Covintec walls, and 012-2011, for accessible restrooms and wall remodeling, were granted many years before the charged events of 2014 and were issued to [Nombre 012]. Those structures are not attributed to the accused, who is alleged to have illegally constructed a concrete sidewalk area encroaching upon 44 square meters of the protection area, a concrete parking area encroaching upon 67 square meters of the protection area, and a concrete storage building encroaching upon 129 square meters of the protection area. These have no connection whatsoever with the aforementioned permits that the judge was alleged to have disregarded. (iv) Regarding the third ground, witness José Luis Guerrero, a municipal official, testified that the accused was ordered on three occasions to halt the construction work (paralización de las obras) encroaching upon the protection area, which consisted of expanding an existing structure.
Those orders were issued to the defendant in his capacity as representative of the owner of the property, because when the official questioned the employees, they told him that the defendant was the owner; the defendant then appeared at the site, insulted the officials, and told the laborers to continue. The witness also reported that the property was registered in the name of [Nombre 032] S. A. and that the defendant was its legal representative, as confirmed by the relevant registry certification concerning the owner of the property and the appointments to the board of directors. This demonstrates that, on the date of the events, the defendant held authority to represent the company in and out of court, as president with the powers of a general agent with unlimited authority (apoderado generalísimo sin límite de suma); the same information also appears in the administrative file of the Municipalidad de Nicoya.
(v) The alleged animosity between [Nombre 011], a business partner of witness Josué Ruiz Guerrero, and the defendant was never established and is not relevant, because the documentary and testimonial evidence demonstrates that the structures whose construction the defendant ordered are located within the protection area of Río Chimpazo and lack permits. (vi) Witness [Nombre 027] described the commercial relationship between Banco Popular and the defendant, stating that once the deed was signed, the latter took possession of the property and began construction work. This is consistent with official letter DRI-02-0559-2021 issued by the Registro Nacional, which states that although Banco Popular was the registered owner of the property in Guanacaste [Valor 003] in July 2014, a purchase-and-sale deed was executed in favor of [Nombre 032] S. A. on 8 July, although it was not recorded in the Registry until 09 September 2014.
Accordingly, the defendant exercised ownership of the property on the date of the events. (vii) The property appraisal reports (peritajes de avalúo) in the Banco Popular file make clear that a structure already existed when the accused acquired the property; however, that structure is not the unlawful act. Rather, the unlawful acts were the expansions made by the accused in the river’s protection area after he acquired the property, as established by expert report DCF:2018-00896-ING prepared by the Organismo de Investigación Judicial. (viii) The structures cannot be allowed to remain, in light of the pro-nature principle (principio pro natura) and the principle of irreducibility of the forest (irreductibilidad del bosque); their removal must be ordered even by the court on its own motion (de oficio), including in judgments of acquittal (voto 2014-1528 of the Tribunal de Apelación Penal de Cartago; 2007-964 of the Tribunal de Casación Penal del Segundo Circuito Judicial de San José; and voto 2007-507 of the Tribunal de Casación Penal de San Ramón).
Therefore, the measure requiring restoration to the original condition (restitución de las cosas a su estado original) accords with constitutional principles intended to protect the environment. (ix) The company [Nombre 032] S. A. must be held jointly and severally liable (responder en forma solidaria) for the environmental damage caused, because it owns the property and because the defendant was its legal representative, as provided in section 57 of the Ley Forestal.
RELIEF SOUGHT (PRETENSIÓN): that the appeal be denied.
At the oral hearing held before the Tribunal de Apelación de Sentencia de Guanacaste, beginning at 10:05 on 14 September 2002, Attorney Zaray Chavarría stated: I request that the judgment remain undisturbed because it satisfies the factual and legal requirements. It was established that the defendant was the person in actual possession of the property. A registry certification states that, at the time of the events, the defendant was the representative in and out of court and therefore exercised control over the property. It is also established that the owner is (inaudible). There is also a certification establishing that, although the property was registered in the name of Banco Popular, the fact is that the transfer deed was executed on the date of the events and, according to the witness, the defendant was the person who signed the deed. Municipal officials likewise determined, through the construction workers, that the defendant was in charge of the work.
He appeared at the construction site and was served with the stop-work order (orden de paralización), but he continued, and is therefore guilty of the acts attributed to him. Regarding the amendment to the Ley Forestal referred to by Defense Counsel, which he contends the judge disregarded, the applicable requirements are specified, and the encroaching structures do not fall under any of them; the demolition order must therefore be upheld. As for the appeal filed by the representative of Banco Popular, the Bank was not ordered to carry out the demolition, nor is the property registered in the Bank’s name. Moreover, if the defendant stops making payments, that is a risk the Bank assumed when it extended the loan (inaudible); thus, the alleged harm is merely prospective and not an actual harm. Regarding the amount of damages awarded under the compensatory civil action (acción civil resarcitoria), a SINAC document sets forth the amount, was not discredited, and served as the basis on which the judge ordered payment (,,,).
It is requested that the decision remain undisturbed.
According to the appellant, this was characteristic of a distracted, careless, and inexperienced judge who was unable to cope with the passage of time. The trial records show that the trial began on 29 April 2022 at 08:16. That first hearing concluded at 11:51. Although it was possible to continue by receiving the testimony of witness [Nombre 027], the Defense objected, arguing that it preferred the prosecution evidence (prueba de cargo) to be presented first (folio 240). For the continuation of the trial, witness José Elías Benavides Fajardo was ordered to appear (folio 245). The trial continued on 10 May 2022 at 08:20, and that hearing concluded at 09:58. On that occasion, the testimony of [Nombre 027] could not be received, and the Defense objected to changing the order of the evidence so that the documentary evidence could be admitted. The continuation was scheduled for 23 May 2022 at 08:00.
At 08:27 on 2 May, the trial resumed, at which time the testimony of [Nombre 027] was received and the documentary evidence was admitted. The hearing concluded at 12:40, and the parties were summoned to appear at 08:00 on 31 May 2022 (folios 263 and 269). At that hearing, which was the last, the parties presented their closing arguments and the trial was declared concluded. The foregoing chronology establishes that none of the trial adjournments exceeded the ten-business-day period referred to in the first paragraph of section 336 of the Código Procesal Penal. Except for the final adjournment, the others were authorized under subsection c) of article 336 of the Código Procesal Penal, either because witnesses failed to appear at trial or because, while testimonial evidence remained to be received, Defense Counsel objected to changing the order in which the evidence was presented. The record does not state why the closing-argument phase did not proceed during the second hearing before the final adjournment.
Nevertheless, there is no record of any objection by the parties, including Defense Counsel, to that adjournment; in any event, this Chamber does not find that this single adjournment rendered the judgment ineffective, particularly because, as discussed below, it did not produce the consequences alleged by the appellant—namely, that the judge was unable to retain an accurate recollection of what occurred at trial when issuing the judgment. Although it is true that the defendant’s name was recorded on folio 9 as [Nombre 007], the context of the judgment as a whole, in which the defendant’s name was correctly recorded, demonstrates that this was merely a clerical error. Regarding the demolition of the structure, as will be explained in our ruling on the fourth ground, the judge likewise neither committed any error nor failed to assess essential evidence concerning that issue, as alleged in the first ground.
Indeed, as argued by the appellant, the aforementioned evidence was neither analyzed nor assessed in the judgment, although it was admitted, as shown by the record on page 248. It is a certification containing a report dated 30 de junio de 2021 concerning property [Valor 003], which is the real property at issue in this litigation, for which two construction permits were granted for two bathrooms and the remodeling of a wall; those permits date from 2009 and 2011. In addition, property declarations made it possible to identify a building on the property that had existed for more than 20 years (cf. pages 246 to 249). Under Article 184 of the Código Procesal Penal, when rendering judgment the Judge is not required to assess all the evidence presented at trial, but only evidence that is essential: “The Court shall assign the corresponding weight to each item of evidence, strictly applying the rules of sound judicial reasoning (sana crítica).
It must adequately explain and substantiate the reasons for assigning a particular weight, based on a joint and harmonious assessment of all essential evidence.” In this Chamber’s view, the evidence cited by the appellant is not essential because it concerns a structure that ceased to exist after being completely demolished. The observations in the first construction-stop order, appearing on page 1 of the administrative case file of the Municipalidad de Nicoya, state the following: “It fails to comply with Articles 79, 84, and 92 of Ley 883 and also fails to comply with Article 33 of Ley 7575. This involves the demolition of the former Bar Happy for the reconstruction of a warehouse measuring approximately 16,5 meters by 23 meters.” The photographs on pages 2 and 7 to 10 readily show remnants of the prior structure, including a fence; three columns can also be seen under construction outside that fence, which was also subsequently demolished.
Accordingly, proof of a preexisting structure that was demolished—that is, that ceased to exist—to erect a new one in its place has no relevance whatsoever to these proceedings. The new structure, whose construction was shown—as will be analyzed in the following sections—to have begun during the first half of July 2014, unquestionably required the corresponding municipal permits, but it also had to comply with the ten-meter protection zone measured from the bank of Río Chipanzo, as was then, and continues to be, established by Section 33 of Ley Forestal number 7575, in force since 16 de abril de 1996. Although the appellant is correct in noting that the preceding Ley Forestal, number 4465, in force since 1969, established in Article 84 a five-meter protection area (área de protección) along both banks of rivers, that provision remained in force only until the amendment to Ley Forestal introduced by Ley number 7174, in force since 16 de julio de 1990.
That amendment to Ley 4465 changed the protection area to ten meters from riverbanks, as provided in Section 68 of Ley Forestal 4465 after the aforementioned amendment; that provision remained in force until it was repealed by Ley Forestal 7575 on 16 de abril de 1996. Accordingly, if the building that existed on the property of [Nombre 032] S. A. at the time of its acquisition had been constructed before Ley 7174 entered into force—that is, before 16 de julio de 1990—it would have been required to maintain only a five-meter protection zone with respect to Río Chipanzo. That fact, however, was not established, because the document dated 30 de junio de 2021 refers to a building more than twenty years old, whereas by that date the amendment to Ley Forestal modifying the protection area as described above was about to reach 31 years in force. In other words, the evidence not assessed by the Judge, on which the ground alleging omission of evidence is based, does not establish with certainty that the referenced preexisting structure was built before 16 de julio de 1990.
It is therefore not essential, and the failure to consider it in the judgment caused no prejudice. In any event, the issue would be relevant if the preexisting structure referred to in the ground of appeal were still standing today; however, as already noted, it was demolished and a new structure was built, which had to comply with the Río Chipanzo protection zone pursuant to Ley Forestal, in force since 16 de abril de 1996.
The foregoing fact concerning representation was included in the factual description of the private indictment (acusación particular); that is, during that period the defendant had legal authority to carry out the construction process attributed to him. Regardless of whether the accused was formally an attorney-in-fact for the legal entity that owned the property where the construction encroaching upon the protection zone (zona de protección) of Río Chipanzo was carried out, it was also proven that the accused was in charge of the work performed on his principal’s property. In this regard, the judgment establishes not only that the encroachment upon the protection zone of Río Chipanzo referred to in the indictment and private complaint (querella) was verified, but also that the accused participated as its perpetrator. In this respect, the intellectual reasoning states as follows: “As a conclusion of the analysis conducted by this Court, in light of the rules of sound rational judgment (sana crítica racional), the rules of logic and experience, and in accordance with the evidence received at the oral and public trial hearings, the Court concludes that the factual allegations set forth in the indictment and private complaint may be deemed proven and that they constitute the offense of Violation of Ley Forestal, in the form of Encroachment upon a Protection Area.
The testimonial evidence received at trial consists of the statement of JOSUÉ RUÍZ GUERRERO, who was an official with the Construction and Public Works Oversight Department of Municipalidad de Nicoya at the time of the events and was also responsible for preparing COMPLAINT IM-220-2015 (folios 1 to 7), which describes the events under investigation, specifically the inspection he conducted of an illegal construction located in Nicoya, fifty meters west of the offices of Periódico la Voz de Guanacaste, at the former Bar Happy. It is identified as an illegal construction because it lacked municipal construction permits. As the witness stated at trial, when he arrived at the location where the work was being performed, he was able to confirm that the construction lacked those permits. In addition, Josué verified that the extension of the structure built on the eastern part of the property was encroaching upon the protection zone of Río Chipanzo.
(...) On the date of the witness’s first visit, when he was a municipal official, 21 de julio del 2014, Mr. Ruiz asked the laborers performing the construction about the owner and the person in charge of the work. The workers proceeded to call the accused, [Nombre 001], who appeared at the location. The witness then notified him of his failure to obtain municipal permits, and the construction was ordered halted for the first time, as recorded in the construction suspension report (acta de paralización de construcciones) appearing at folio 01 of the copies of the administrative case file (expediente administrativo). That folio bears the accused’s signature as the person notified in his capacity as owner and person in charge of the work. The witness explained that, as of 21 de julio del 2014, the work was twenty percent complete, as may be seen in the photographs appearing at folio 02 of the copies of the administrative case file.
Those photographs clearly show the construction of three concrete-block columns and metal purlins. This information was also verified at trial by the witness JESUS ALBERTO ABADIA VARGAS, who, although he did not recall many details of the events, spontaneously stated that he had gone to the property where Bar Happy had formerly operated. He was a municipal official at the time, and he stated that he recalled people constructing columns made of concrete blocks. On 21 de julio del 2014, in addition to halting the accused’s work, he was granted thirty days to appear before Municipalidad so that he could satisfy the requirements applicable to his construction, and he was also advised that failure to comply would result in demolition of the work. Mr. [Nombre 001], disregarding the warnings issued to him, continued the work, as recorded in the report prepared at eleven hours on 19 de setiembre del 2014.
This information was confirmed in the adversarial proceeding (contradictorio) by the witness Ruíz Guerrero, who stated that they inspected the construction again that day and confirmed that it had been completed. This information can be verified from the sequence of photographs appearing at folios 07 to 10 of the copies of the administrative case file. These show that, at the location where there had been a chain-link fence and three columns made of concrete blocks, additional fully completed concrete columns and a completely finished concrete wall had been built, and the fence had been removed from the site. This construction is located on the eastern side of the property, parallel to Río Chipanzo. The entire roof structure of this building had also been fully completed. For this reason, officials of Municipalidad de Nicoya again ordered the work closed. Once the work was closed, the persons working on the construction called the accused, and Mr. [Nombre 001] again appeared at the location.
He was informed that he had to stop the work and could not continue until he had brought it into compliance. [Nombre 001] expelled the municipal employees from the location, including the witness Josué, who stated that the accused became somewhat violent. Afterward, Mr. [Nombre 001] ordered the workers to continue performing their duties. The witness further stated that [Nombre 001] possessed this property, which was registered in the name of a company. They verified this information in the registry, where [Nombre 001] appeared as its legal representative. He stated that the company was named [Nombre 032]. Mr. [Nombre 001] refused to stop the construction process and told them that he intended to proceed. At trial, this witness gave a clear statement recounting what he had learned through the performance of his duties and detailing the manner, time, and place in which the acts charged against [Nombre 001] occurred, based on the visit they made to the scene.
The witness clearly stated that the construction lacked the corresponding permits and was encroaching upon the protection area (área de protección) of Río Chipanzo. This testimony is supported by the documentary evidence (prueba documental) validly admitted into the proceedings, which provides important information for assessment and is essential to finding that the offense under investigation was committed. The trial also included the testimony of Mr. [Nombre 023]. This witness stated that he was an official of SINAC from 2007 to 2019. He explained that the protection area for a river channel (cauce) in an urban area is ten meters. The property of [Nombre 032] S.A., which at the time of the events was represented by the accused, is located in an urban area and must therefore maintain a distance of ten meters. The purpose of this requirement is to allow the river to shift and rise when its channel swells.
With respect to this particular case, he stated that, following a complaint received on 29 de julio del 2014, he was assigned to measure the protection area of Río Chipanzo on land located in Nicoya, near Municipalidad, on the road to Estadio, by the small bridge located there. On 06 de agosto del 2014, he went to the property in question. He added that he knew it was the property of [Nombre 001] because he later learned that it belonged to that gentleman, who represents verdulería Sammy. Upon arriving at the location, he confirmed that the construction being performed on the property was encroaching upon the protection area. He stated that purlins and an eave were being built toward the river, extending from a preexisting old wall. The builders were advised that they should not perform this work. They stated that they had the corresponding permits, but never produced them. The witness proceeded to take the corresponding measurements and determined that the rear of the property was four meters and forty centimeters from the river, the center of the property was three meters from the river, and the front of the property was six point twenty centimeters from the channel of Río Chipanzo.
The information provided by the witness at trial is also supported by the documentary evidence, report ACT-OSRN-247-2015, which also records a second visit made by the witness to the construction on 29 de enero del 2015 at the request of the Environmental Management Department of Municipalidad de Nicoya. During that visit, it was again determined that a wall was encroaching upon the protection area of Río Chipanzo. The measurements were taken again and yielded exactly the same results as those from the first visit, thereby once again establishing that an encroachment upon the protection area existed. The prosecution witnesses (testigos de cargo) gave comprehensive responses to the parties during the adversarial proceeding, provided the details requested of them, and revealed no indication—much less evidence—that they intended to link the accused to an offense merely out of a desire to harm him.
They are two qualified witnesses, trained in their duties to conduct an investigation into an alleged offense involving a violation of Ley Forestal. Each prosecution witness gave a statement demonstrating the strength and consistency necessary to maintain his account of the actions he performed, showing candor as to the details of what each was able to observe or do, in keeping with the division of responsibilities they had during the investigation in the case before us. There is no trace of falsehood in their statements, and both remained consistent with what had been recorded.
The information provided by the aforementioned witnesses is consistent with the documentary evidence (documentos probatorios) in the proceedings; for example, the record includes Report number 115-DM-SDRN-18, dated 26 de marzo del 2018, prepared by the Judicial Investigation Agency of Nicoya, which states that investigators Wilmar Pérez Bermúdez and Freddy Porras Morales, after speaking with witness Josué Ruíz Guerrero, were informed by him that the Municipality had not granted any construction permit to Mr. [Nombre 001], who acquired the property from Banco Popular and subsequently proceeded to carry out remodeling work on this building. Mr. Ruíz Guerrero also told them that the construction was within the protected area (zona protegida) of the río Chipanzo. The investigators traveled to the site, specifically in Nicoya, Barrio Chorotega, one hundred meters south and one hundred meters west of the Municipalidad de Nicoya, where they did in fact locate a building on the left side of the road, after the bridge.
On the east side of the building, there is a wall constructed parallel to the río Chipanzo; a distance of two meters and forty centimeters can be observed from the edge of the river’s flow to the wall. This information was also confirmed by Inspection, Search, and Evidence Collection Record (Acta de Inspección, Registro y Recolección de Indicios) number IO-SRDN-17 of the Judicial Investigation Agency of Nicoya, in which the aforementioned investigators state that, upon arriving at the site, they observed a building intended for use as commercial premises; at the time of the visit, no commercial activity was observed inside. The building borders the public street to the north and has an approximate frontage of eighteen meters by thirty-five centimeters in depth. The east side of the property borders the río Chipanzo, with a distance of two meters and forty centimeters from its riverbed to the building wall.

In addition to the foregoing, the following technical evidence is in the record: a) Report DA-UHTPNOL-0455-2018 of the Ministry of Environment and Energy, Water Directorate, in which two engineers from the Tempisque North Pacific Hydrological Unit detail the results of their site inspection. These professionals determined that the permanent río Chipanzo, whose riverbed is in the public domain (dominio público), was located on the east side of the property registered in the Province of Guanacaste under registration number [Valor 003]. b) Expert Report (Dictamen Pericial) 2018-896-ING, prepared by the Forensic Engineering Section of the Judicial Investigation Agency. This report was prepared by Judicial Expert 2 Álvaro Mauricio Rojas Porras and determined that the construction was located in Guanacaste, Nicoya, at the following geographic coordinates: north latitude: 10 degrees 08 minutes 26.7 seconds; west longitude: 85 degrees, 27 minutes, 16.2.
The accused (imputado), [Nombre 001], was present during this proceeding. A topographic survey (medición topográfica) was conducted using a total station, covering the riverbank, the bridge as a reference point, and the reported building. The construction is located in an urban sector, and a ten-meter protective setback (retiro de protección) was therefore applied. The survey found that the protection area (área de protección) contained a sidewalk encroaching upon forty-four square meters of the protection area of the río Chipanzo; a parking area encroaching upon sixty-seven square meters of the protection area; and a building encroaching upon one hundred twenty-nine meters of the protection area of the aforementioned river. c) Technical Report Assessing Environmental Damage (Informe Técnico de Valoración del Daño Ambiental) caused within the protection area, INFORME TÉCNICO ACT-OSRN-605-2018, prepared by the Ministry of Environment, Energy and Telecommunications, National System of Conservation Areas, Tempisque Conservation Area; folios 59 to 60.
This technical report was prepared by Mr. [Nombre 024] and [Nombre 025] following the field visit conducted on 28 de julio del 2014 to the property located in [Nombre 026]. It estimated the value of the environmental damage caused by the work performed by the defendant (encartado) within the protection area of the río Chipanzo at CUATRO MILLONES CUATROCIENTOS MIL COLONES EXACTOS. With respect to the first fact found proven (hecho probado) in this judgment, it is undisputed and was not contested that the property registered in the Province of Guanacaste under registration number [Valor 003], cadastral plan (plano catastrado) number [Valor 006], has been owned by [Nombre 032] de Nicoya Sociedad Anónima, corporate identification number [Valor 004], since ocho de julio del 2014, the date on which that company purchased the aforementioned real property from Banco Popular y de Desarrollo Comunal through the certified copy of the deed (testimonio de escritura) executed at nueve horas on that date and submitted to the Real Property Registry on 25 de agosto del 2014, according to [...], which was duly recorded on 09 de setiembre del 2014.
This information can be verified in the Certification of Historical Registry Transactions (Certificación de Movimientos Registrales Históricos) issued by the Legal Advisory Department of the Real Property Registry and prepared by attorney Diiter Chaves Gehring. Regarding the second fact found proven in this judgment, it is important to emphasize that this Court has no doubt that during the first half of julio del 2014, on the property described in the preceding paragraph, the accused [Nombre 001], knowing that his acts were unlawful, encroached upon the protection area of the río Chipanzo by constructing a concrete sidewalk that encroached upon 44 square meters of the protection area, a concrete parking area that encroached upon 67 square meters of the protection area, and a concrete storage building that encroached upon 129 square meters of the protection area. The defense theory (tesis de defensa) is that, when the investigation began, [Nombre 001] was no longer the representative of the company that encroached upon the protected area and, furthermore, that it had not been proven that the defendant was the person carrying out construction on the property.
For these reasons, the defense argues that the accused [Nombre 001] cannot be convicted. These arguments are not supported by the evidence because, first, as shown by the administrative file (Expediente Administrativo) of Banco Popular y de Desarrollo Comunal—which was submitted by defense counsel as evidence to assist the court in reaching its decision (prueba para mejor proveer—the certified copy of the public deed (escritura pública) executed in San José at nueve horas on ocho de julio del dos mil catorce, through which Banco Popular y de Desarrollo Comunal sold to [Nombre 032] Sociedad Anónima the property registered in the Province of Guanacaste under registration number [Valor 003], reliably establishes that the person appearing on behalf of that company was the accused [Nombre 001]. In other words, on 08 de julio del 2014, the defendant was still the legal representative (representante legal) of the aforementioned company.
In addition, testimony was received at trial from Mr. [Nombre 027], who works for Banco Popular in this locality. This witness stated that he remembered the defendant [Nombre 001] because he was the representative of [Nombre 032], the company that purchased a property awarded to the bank. The witness further explained that the normal procedure for selling such properties is to appoint someone to live in and care for them while the Bank proceeds with the sale; this person is called a borrower for use (comodatario). The normal procedure is that, once the Bank sells the property, the person residing there is given at least fifteen days to vacate it. At trial, the witness spontaneously added that he clearly remembered the case of Mr. [Nombre 001] because, once the accused signed the purchase deed and mortgage instrument, he immediately evicted the borrower for use from the real property purchased by the company that [Nombre 001] represented at that time.
Another extremely important fact mentioned by this witness is that the person caring for the property told him that construction was already underway there, even though the borrower for use had not yet vacated it. Mr. [Nombre 027] stated that he went to the property and, when he spoke with the person in charge of construction, that person immediately called Mr. [Nombre 001], who told him that he—the accused—was already the owner of the property, that the deed had already been signed, and that he was therefore the property’s owner. This witness’s testimony completely discredits the defense theory. The evidence in the case file establishes that, when work began on the aforementioned property and encroached upon the protection area, the defendant was the legal representative of [Nombre 032] S.A. and was also the person supervising the construction workers who carried out the expansion of that property.
Moreover, the accused participated throughout the proceedings, from the moment the work was first halted and even during the field inspection conducted for the topographic survey of the property, as noted above. Accordingly, the defense’s argument cannot be accepted. On the contrary, the prosecution witnesses and witness [Nombre 027] provided compelling evidence which, when considered together with the documentary evidence, proves with certainty the factual allegations (cuadro fáctico) charged by the Public Prosecutor’s Office, pursued by the Procuraduría General de la República as private complainant (querellante), and detailed in the allegations of the Civil Action for Damages (Acción Civil Resarcitoria). The accused, for his part, testified at trial that these entire proceedings resulted from personal problems with his brother, [Nombre 011], who holds an important position at the Municipalidad de Nicoya.
According to the accused, this is why Mr. Josue Ruíz has persecuted him, and there are many circumstances driving that persecution; he has all the permits, everything is in order, and there are things he does not understand. When assessed together with the other evidence in the proceedings, this testimony by the accused has no support whatsoever. First, it has not been established that the accused was subjected to any personal persecution or that such persecution was the principal reason criminal proceedings were brought against him for the offense of encroachment upon a protection area of the río Chipanzo. On the contrary, upon assessing the evidence in the case file, this authority determined that the accused [Nombre 001] acted unlawfully, which is why criminal proceedings were instituted against him. It must be recalled that, when the Municipal authorities arrived at the construction being carried out by the accused, they halted the work and granted him a period of thirty days to appear before the Municipalidad de Nicoya and comply with the legal requirements.
Nevertheless, disregarding those warnings, the accused decided to continue the work until it was completed. Thus, the accused cannot claim that he was persecuted when it was he who, acting with full knowledge, decided to violate the law, even ignoring on two occasions the warnings issued by the inspectors of the Municipalidad de Nicoya and deciding on his own to complete the work that had been halted.
Another important aspect is that Mr. [Nombre 001] states that he had all the permits for these works, but no such information appears in the case file, and the defense submitted no evidence whatsoever to corroborate Mr. [Nombre 001]’s statement” (folios 283 to 288).
As is clear from the judgment’s extensive reasoning regarding the evidence, it adequately explained why the charged facts and the facts alleged in the private complaint were deemed proven and why the accused, [Nombre 001], was found to have participated in them as the principal. As noted supra, he was not only the president and representative of the corporation that owned the property on which the construction work was carried out, but, during the inspection visits conducted by municipal officials José Ruiz Guerrero and Jesús Alberto Obadía Vargas, the construction workers identified him as the contractor for the work. In that capacity, he appeared at the site and was served with the stop-work orders, actions that were duly documented in the administrative case file (expediente administrativo) of the Municipalidad de Nicoya submitted as evidence. The assessment of the evidence conducted by the lower court (a quo) complies with the requirements of section 184 of the Código Procesal Penal, insofar as it is the product of a comprehensive and harmonious assessment of the testimonial, documentary, and expert evidence, all of which is entirely consistent.
The essential aspects of the facts constituting the criminal charge could be established through the different items of evidence because they were mutually consistent and corroborative, as the trial judge emphasized in the challenged judgment. In light of all the foregoing, the appellant is entirely incorrect in arguing that he was deemed the principal merely because he was the attorney-in-fact of the corporation that owned the property. Nor is there merit to the argument that the judge stated that the accused signed reports without identifying them, when the judgment clearly refers to the construction-stoppage report on folio 1 of the administrative case file of the Municipalidad de Nicoya. Although the testimony of Josué Ruiz formed part of the body of evidence on the basis of which the facts and the accused’s authorship of the alleged encroachment upon the protected zone (zona protectora) were deemed proven, as just noted, that finding was not based solely on that witness’s statement.
It was also based on the testimony of Obaldía Vargas and documentary evidence such as construction-stoppage reports, photographs, reports from the Sistema Nacional de Conservación del MINAE, the court-ordered expert examination (pericia judicial), and, in general, the documentation introduced at trial. Accordingly, even if it were hypothetically accepted that Josué Ruiz conducts business with a brother of the accused who is his enemy, any such disagreements, if they exist, clearly had no bearing whatsoever on the establishment of the facts or on the determination that the witness was credible, his testimony having been found credible. Nor is it relevant that, as a formal matter, on the date of the events the property at issue remained registered in the name of Banco Popular, or that in an asset declaration submitted to the Municipalidad de Nicoya the representative of Banco Popular stated that the institution owned it.
As is clear from the testimony of [Nombre 027], described beginning on the front of folio 281 and included in the transcription of the judgment’s reasoning regarding the evidence, on the date of the events the accused was in possession of the property in question, which was owned by the entity he represented, [Nombre 032] S. A. The witness testified that, from the time the deed of conveyance was executed, the accused took possession of the real property, and it was not possible to complete the procedure of notifying the borrower for use (comodatario) responsible for the property so that possession could be delivered; instead, the accused evicted him from the property. Furthermore, it was proven that the property was conveyed on 8 de julio de 2014, although the instrument was not registered until 9 de setiembre de 2014 (cf. folio 30), which explains why the property remained formally registered in the name of Banco Popular until that time, an entirely immaterial circumstance.
The appellant contends that there is no evidence that, on the date of the events described in the criminal charges, the accused had encroached upon the protected zone of the Río Chipanzo, because the witness José Elías Benavides stated that the portion encroaching upon the protected area and not constructed in accordance with the law—a 5-meter setback (retiro)—was an eave that was not attached to the ground. He further notes that report ACT-OSRN-122-14 of 6 de agosto de 2014, on folio 45, recommended authorizing construction after determining that there was no encroachment upon the river’s protected zone; therefore, if the events occurred, they must have occurred between 6 de agosto de 2014 and 30 de enero de 2015. That argument is without merit. Although it must be accepted that by the first half of julio de 2014 the encroachment upon the protected zone of the Río Chipanzo had not been completed in its entirety—because, as the testimonial evidence shows, the work was 20% complete—and the photographs on folio 2 of the Municipalidad de Nicoya case file likewise show that the structures had only just begun to be erected, the fact remains that, as of that time, the witness Josué Ruiz Granados detected that the protected zone of the Río Chipanzo was being encroached upon.
He so testified at trial and recorded it in the report on folio 1. The photographs on folio 2 show the construction of three columns outside the fence located along the river boundary. Thus, the process of encroaching upon the protected area was clearly already underway on the date of the charged events, and by 19 de setiembre de 2014 it had been fully completed, with the construction of the roof and perimeter walls 100% complete (cf. reports and photographs on folios 6 through 10). The Organismo de Investigación Judicial conducted its expert examination of the completed structure (folios 25 through 27 of the main case file), reaching the previously stated conclusions regarding the impact on the protected area of the Río Chipanzo. In light of such compelling evidence, the inspection report on folio 45, dated 6 de agosto de 2014 and signed by [Nombre 023], an official of the Sistema Nacional de Áreas de Conservación, which concluded that the river was 10 meters from the proposed construction site and recommended issuing certification for construction purposes, must be treated with caution and accorded no evidentiary weight; that evidence must be rejected because abundant documentary and testimonial evidence establishes that the protected zone was encroached upon from the outset of construction.
The same official subsequently determined that the encroachment existed (report on folio 46), reaching the same conclusion as the Organismo de Investigación Judicial. He also testified at trial that, during the visit conducted on 6 de agosto de 2014 that resulted in the report on folio 45, he likewise confirmed the encroachment upon the protected zone of the Río Chipanzo, thereby contradicting the information recorded in that report regarding the absence of any impact on the protected zone of the Río Chipanzo. Accordingly, the appellant is incorrect in maintaining that the encroachment occurred after 6 de agosto de 2014. It began during the first half of julio de 2014, as correctly determined in the judgment, and the process of encroachment had been completed by 9 de setiembre de 2014, as just noted. Finally, the failure to consider the credit file (expediente crediticio) for purposes of establishing the existence of preexisting buildings when [Nombre 032] S. A. acquired the property does not constitute any defect in light of the foregoing.
The accused demolished those structures to carry out the new construction, and in any event both the prior and the new structures were required to maintain a 10-meter protected-zone setback from the bank of the Río Chipanzo. The fact that the preexisting structure encroached upon the protected zone did not grant the corporation holding title to the property any right to perpetuate that encroachment, much less by constructing works to replace the existing structures, even if they were built in the same location as the former structures.
Both the Ministerio Público, represented by attorney Luis Diego Quesada Canales, and attorney Zaray Chavarría, representing the Procuraduría General de la República, requested that the joinder appeal be declared inadmissible because the judgment caused no prejudice to the creditor institution. This Appellate Chamber finds the appeal filed by the representative of Banco Popular admissible. The appellant argues that Banco Popular is adversely affected by the order restoring matters to their original condition (restablecimiento de las cosas a su estado original), as issued in the judgment, because it entails a depreciation of the mortgage security held by Banco Popular in connection with the loan granted to the corporation [Nombre 032] S. A., which holds title to the property. From that perspective and considered in the abstract, it is possible that the joining appellant could suffer prejudice if the ordered demolition of the construction is improper, an issue that will be resolved when we address the merits of the appeal.
On the merits, the fourth ground of the appeal filed by defense counsel and the joinder appeal filed by the representative of Banco Popular are denied. Both argue that restoring matters to their original condition is improper. Attorney Porras Leiva argued that, according to the environmental-damage assessment report on folio 60, the building existed at the time of the charged events, when a five-meter protected area from the riverbank was required, and therefore it was built in accordance with law and its destruction was not warranted. Consequently, demolition was warranted only with respect to what had been built by the date of the events, but even that was unwarranted because, according to the report on folio 45 of the administrative case file of the Municipalidad de Nicoya, there was no encroachment upon the protected area of the Río Chipanzo, since the river was 10 meters from the structure.
He maintains that the preexisting structure should not be demolished because it had the respective permits, as shown by the evidence submitted on folios 245 through 248 of the main case file. He concluded by stating that [Nombre 032] de Nicoya was the only party deceived, because it purchased a property without knowledge of its latent defects (vicios ocultos) concerning the restrictions arising from the protected area. Attorney Víctor Hugo Castro Cartín added that no evidence had been submitted establishing what percentage of the structures currently standing constitutes new construction, which is the portion subject to demolition.
It is again asserted that the Ley Forestal preceding the one currently in force, which remained in effect until April 16, 1996, established a five-meter protection zone (zona de protección) along both sides of riverbanks on flat land, and that this is stated in the environmental damage assessment (valoración del daño ambiental) on record page (folio) 60. The foregoing was already analyzed by this Chamber in the preceding sections, where it was determined that, although the protection zone for rivers on flat land was initially 5 meters (Article 84), this changed as of July 16, 1990, when Ley número 7174 entered into force, amending Ley Forestal 4465 and establishing a 10-meter protection zone for rivers on flat land (Article 68). That protection zone has remained in place to date, for nearly 31 years, because the current Ley Forestal, in force since April 16, 1996 (número 7575), provides for the same 10-meter protection zone for land in urban areas and on flat terrain, as is the case here.
It was also previously found that it had not been established as a proven fact that the building existing when [Nombre 032] S. A. acquired the property in question had been constructed before the aforementioned amendment to Ley Forestal 4465, which took effect on July 16, 1990. As stated, this is immaterial because that building was demolished and the current one was erected in its place. The claims continue to assert that restoration to the original condition (restitución de las cosas al estado original) would entail only the demolition of what had been built as of the date of the events, and not the preexisting structure. The preceding section (C) analyzed and resolved, based on the evidence submitted in the administrative proceeding (expediente administrativo) of the Municipalidad de Nicoya, that the preexisting structure was demolished by workers hired by the defendant and ceased to exist, having been replaced by a new structure.
For that new construction to be carried out, it not only required the corresponding municipal permits—a requirement that was not met—but also had to respect the protection area (área de protección) of Río Chipanzo, consisting of a ten-meter strip measured from the riverbank because the property is flat land located in an urban area (Article 33 of Ley Forestal). The location of the former structure, which ceased to exist, conferred no right whatsoever upon the property owner if it was situated within the protection zone, as suggested by the cross-appeal (recurso por adhesión), because that structure had been built in violation of Ley Forestal, whether under the repealed Ley 4465 or the current Ley 7575. Accordingly, if the former structure still existed and had been shown to encroach upon the protection zone of Río Chipanzo, as the wire fence in fact did, demolition would likewise have been appropriate until the protection zone was fully cleared, even if the works had been performed with authorization from the Municipalidad and even if, for that reason, criminal and civil liability could not have been imposed on the defendant or civil liability on the owner company.
This explains why the environmental damage assessment was performed only with respect to the portion of the structure that expanded the encroached area beyond the footprint of the previously existing building, an assessment that has not been challenged in any respect. But the damage assessment is only that: the determination, in monetary terms, of the harm caused for which the civil defendants (demandados civiles) may be held liable. It is not a determination of the encroached area or of the protection zone that must be cleared. Those matters were established through measurements taken by officials of the Sistema de Conservación Áreas de Protección del MINAE, and particularly by the Organismo de Investigación Judicial, as was extensively analyzed in the preceding section (C). The preceding section also determined that the report on record page 45 lacked evidentiary value (valor probatorio), in the context of the evidence considered as a whole, and because the very official who signed it, witness José Elías Benavides, stated in his testimony at trial that on that occasion he had verified the encroachment upon the protection zone.
The contents of that document therefore do not reflect what actually occurred. Nor, in circumstances such as these, can the argument be accepted that [Nombre 032] S.A. was deceived because it purchased a property with latent defects (vicios ocultos). It has not been established in these proceedings that Río Chipanzo was not readily visible. On the contrary, it is even described as one of the property boundaries, and a claim of ignorance of legal provisions that have been in force for more than thirty years cannot be accepted. Any uncertainty in that regard could have been timely resolved by the legal professionals who authenticated the deed of conveyance (escritura de traspaso). The foregoing reasoning applies equally to the civil co-defendant (codemandado civil) Banco Popular, which owned the property at issue and should have taken compliance with the protection zone into account when appraising the property and accepting it as mortgage security (garantía hipotecaria).
Furthermore, it is evident that, in this case, the loan was not authorized for the demolition of the existing structure and the construction of the warehouse, parking area, and sidewalk, but rather for remodeling the existing structure, as witness [Nombre 027] testified. It is more than evident that Banco Popular, as creditor, did not adequately supervise the use of the loan and must therefore likewise bear the losses resulting from the impairment of its security caused by restoration to the original condition, which entails demolishing what was built until the protection zone of Río Chipanzo is fully cleared. This is precisely what the judgment ordered, based on the expert determination (cf. operative part, record pages 301 reverse to 302 front).
The ground alleges the absence of a legal relationship (vínculo jurídico) due to the absence of environmental damage as of June 2015. It is argued that the judgment found facts to have been proven that were not supported by the evidence, that those facts in turn served as the basis for the civil judgment, and that the judge failed to evaluate the expert report (peritaje) on record page 61, which established that there was no impact whatsoever within the protection zone of Río Chipanzo at the boundaries of property [Valor 003] and, therefore, no environmental damage. The claim is unfounded. First, it proceeds from an assertion that has been entirely disproved—namely, that the proven facts are not supported by the evidence. This has already been extensively analyzed throughout this ruling, which determined that the challenged judgment correctly established the facts. Second, the document on record page 61 of the Municipalidad de Nicoya administrative proceeding, on which the appellant bases the allegation that no environmental damage existed, merely states that the protection area of Río Chipanzo was not affected in any of the following ways: tree cutting (tala de árboles), earthworks (movimientos de tierra), water diversion (desvío de aguas), or pollution by sewage or soapy wastewater (contaminación con aguas negras o jabonozas).
This does not exclude the possibility that the protection area was affected through encroachment upon the protection zone of Río Chipanzo, as the judgment found proven—namely, beginning in the first half of July 2014—and through a form of impact not excluded by the cited document on record page 61, that is, by encroachment. The impact on the environment caused by that encroachment is precisely what was assessed as environmental damage. Of the total proven encroachment, only an area of 44 square meters was considered for that purpose, as shown by the document on record pages 59 to 60 of the principal case file, and this was not challenged in any respect. This was not because the encroachment was limited to that area, but because, according to the expert, it corresponded to the expansion, as of the date of the events, of the area already encroached upon before the owner company acquired the property—an uncovered yard enclosed by chain-link fencing—and before it demolished the preexisting structure and built a new one.
Likewise, low-environmental-impact works are authorized, such as observation platforms, bridges, suspension bridges, zip lines, signage, and other elements that provide access to, observation of, and safe enjoyment of natural areas with the least possible impact, when intended for the development of tourism activities, among others.” None of the foregoing forms part of the arguments presented by the appellant, much less was it established that the construction carried out served any of the stated purposes or had the corresponding authorization.
VII.The appealed judgment ordered the restoration of the property to its prior condition (restitución de las cosas a su estado anterior) through the demolition of the structures and buildings located within the protection area (área de protección) of the property registered in the Partido de Guanacaste under registration number [Valor 003], located in [...], owned by [Nombre 032] de Nicoya Sociedad Anónima, as stated in the Supplemental Expert Report (Ampliación de Dictamen Pericial) DCF:2018-00896-ING, prepared by the Departamento de Ciencias Forenses, Sección de Ingeniería Forense, Organismo de Investigación Judicial, because they encroach upon a protection zone (zona de protección). To comply with the foregoing, the accused and civil defendant (demandado civil), [Nombre 001], was granted a period of two months from the date on which the judgment becomes final to demolish the structures built within the protection area of Río Chimpanzo, bearing the costs of demolishing the structures and removing the materials from the affected site.
The Ministerio de Ambiente, Energía y Telecomunicaciones, Sistema Nacional de Áreas de Conservación, Área de Conservación Tempisque, is ordered to conduct an inspection and submit a report to verify compliance with the orders issued in this judgment. [Nombre 001] is hereby warned that compliance with this ruling is mandatory and that criminal proceedings may be brought against him for the offense of Disobedience of Authority (Delito de Desobediencia a la autoridad) in the event of noncompliance. This Chamber finds that this aspect of the judgment must be expanded sua sponte (oficiosamente), both in the reasoning and in the operative provisions, to also include the civil co-defendant (codemandada civil), [Nombre 032] S. A., as responsible for the ordered demolition, because it is the owner of the property on which the structures to be demolished are located; therefore, the same warning issued to the accused must also be issued to the legal representative of that company, Ms. [Nombre 037].
Restoration of the property to its original condition is a civil consequence of the offense (Article 103, subsection 1, of the Código Penal), and legal entities (personas jurídicas) are civilly and jointly and severally liable with their managers and administrators who are found responsible for the criminal acts (hechos punibles) (Article 106, subsection 2, of the Código Penal and Article 57 of the Ley Forestal).
POR TANTO:
Based on the foregoing, the appeal filed by attorney Jorge Enrique Porras Leiva in his capacity as defense counsel for the accused, [Nombre 001], and as special judicial attorney-in-fact (apoderado especial judicial) for the civil co-defendant, [Nombre 032] S. A., and the cross-appeal (recurso de apelación por adhesión) filed by attorney Víctor Hugo Castro Cartín on behalf of Banco Popular y de Desarrollo Comunal are hereby denied. Sua sponte, section VI of the operative provisions of the challenged judgment is amended and expanded to read as follows: VI.- Regarding restoration of the property to its prior condition: Once the judgment becomes final, and pursuant to Article 140 of the Código Procesal Penal, Article 103 of the Código Penal, and Articles 33, 34, and 58, subsections a) and b), of the Ley Forestal, restoration of the affected protection zone to its original condition is hereby ordered; likewise, the demolition of the structures and buildings located within the protection area of the property registered in the Partido de Guanacaste under registration number [Valor 003], located in [...], owned by [Nombre 032] de Nicoya Sociedad Anónima, is hereby ordered, as stated in the Supplemental Expert Report DCF:2018-00896-ING, prepared by the Departamento de Ciencias Forenses, Sección de Ingeniería Forense, Organismo de Investigación Judicial, because they encroach upon a protection zone. [Nombre 001] and the civil co-defendant, [Nombre 032] S. A., represented by its president, Ms. [Nombre 037], who holds the powers of a general attorney-in-fact without limitation as to amount (apoderada generalísima sin límite de suma), are granted a period of two months after the judgment becomes final to demolish the structures built within the protection area of Río Chimpanzo, bearing the costs of demolishing the structures and removing the materials from the affected site.

PODER JUDICIAL TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL JUVENIL Resolución: 2023-0044 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL JUVENIL. Segundo Circuito Judicial de San José. (En función del T.A.S.P de Guanacaste, sede Santa Cruz) Goicoechea, a las diez horas del treinta de enero de dos mil veintitrés.
RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra [Nombre 001], [...], por el delito de INVASIÓN A UN ÁREA DE CONSERVACIÓN O PROTECCIÓN, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los jueces Jorge A. Camacho Morales, Gustavo A. Jiménez Madrigal y la jueza Flory Chaves Zárate. Se apersonó en esta sede el licenciado Jorge Enrique Porras Leiva, Defensor Particular del imputado, el licenciado Victor Hugo Castro Cartín, del Banco Popular, la licenciada Zaray Chavarría Prado, Procuradora Penal y el licenciado Luis Diego Quesada Canales, en representación del Ministerio Público.
RESULTANDO:
I.Que mediante sentencia número 107-2022, de las siete horas treinta minutos del primero de junio del dos mil veintidós, el Tribunal de Juicio del Segundo Circuito Judicial de Guanacaste, Nicoya, resolvió: "POR TANTO: Una vez firme la sentencia y de conformidad con el artículo 140 del Código Procesal Penal, 103 del Código Penal, y 33, 34 y 58 incisos a) y b) de la Ley Forestal, se ordena la restitución de la cosas a su estado original de la zona de protección afectada; así mismo, se ordena el derribo de las estructuras y construcciones ubicadas dentro del área de protección de la finca inscrita en el Partido de Guanacaste, matricula número [Valor 003], ubicada en la [...], propiedad de [Nombre 032] Sociedad Anónima, según lo indicado en la Ampliación de Dictamen Pericial DCF:2018-00896-ING, elaborado por el Departamento de Ciencias Forenses, Sección de Ingeniería Forense, Organismo de Investigación Judicial, esto por estar invadiendo una zona de protección.
Se otorga el plazo de dos meses después de la firmeza de la sentencia, para que [Nombre 001] , proceda con el derribo de las estructuras construidas dentro del área de protección del Río Chimpanzo, corriendo a su cuenta los gastos por concepto de derribo y retiro de materiales del lugar afectado. Se ordena al Ministerio de Ambiente, Energía y Telecomunicaciones, Sistema Nacional de Áreas de Conservación, Área de Conservación Tempisque, realizar la inspección y rendir el Informe a fin de constatar el cumplimento de lo ordenado en la presente sentencia. Se previene a [Nombre 001] , del carácter obligatorio de lo que se resuelve, pudiéndosele seguir causa por el Delito de Desobediencia a la autoridad en caso de incumplimiento. Comuníquese lo aquí resuelto a la Municipalidad de Nicoya, Guanacaste. Para la lectura de la sentencia integral se fijan dieciséis horas del 08 de junio del 2022. MEDIANTE LECTURA NOTIFÍQUESE. Olman Carballo Badilla. Juez del Tribunal de Juicio de Nicoya. (sic.fl.301 vlto y fl 302)".
II.Que contra el anterior pronunciamiento interpuso recurso de apelación el licenciado Jorge Enrique Porras Leiva, Defensor Particular del imputado, el licenciado Victor Hugo Castro Cartín, del Banco Popular.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta el Juez de apelación Camacho Morales; y,
CONSIDERANDO:
I.Al Tribunal de Apelación de Sentencia Penal Juvenil, por acuerdo firme adoptado por la Corte Plena en la sesión número 22-2022 del dieciséis de mayo de dos mil veintidós, se le amplió la competencia para conocer también de la materia penal ordinaria competencia del Tribunal de Apelación de Sentencia de Guanacaste, sede Santa Cruz, ampliación de competencia prorrogada por Corte Plena en sesión 65-2022, celebrada el 19 de noviembre de 2022, artículo XVII, hasta el 11 de julio de 2023, razón por la cual esta Cámara de Apelaciones resulta competente para conocer y resolver los recursos de apelación de sentencia de la jurisdicción penal de adultos de la provincia de Guanacaste.
Tal y como consta a folio 374, el día 14 de setiembre de 2022 se celebró audiencia oral en el Tribunal de Apelación de Sentencia Penal de Guanacaste, sede Santa Cruz, integrado en esa oportunidad, por los jueces José Manuel Cisneros Mujica, Rodrigo Obando Santamaría y la jueza Brisa Campbel Argüello, oportunidad en la cual todas las partes plantearon sus argumentos, los cuales ya constan por escrito, a excepción de la representación fiscal, sin que se recibiera algún elemento probatorio. En virtud de la distribución de competencias explicada en el considerando anterior, ordenado por la Corte Plena del Poder Judicial, el expediente fue remitido a este tribunal, lo cual no acarrea perjuicio alguno a las partes, tal y como lo ha resuelto la Sala Constitucional en estos casos: "...resulta constitucionalmente válido que en aquellas vistas o audiencias orales de casación en las que no se reciban elementos de prueba en forma oral o, que las argumentaciones de las partes consten ya por escrito, sin que se aporte nada nuevo, puedan intervenir otros jueces, distintos a los que participaron en la vista, a la hora de tomar la decisión, si y sólo si, están en capacidad de hacerlo y existen razones justificadas (que deberán constar) que impidan que quienes estuvieron en la audiencia oral se reúnan en fecha próxima a estudiar y resolver el asunto…” (Sala Constitucional, N.º 6681 de las 15:30 horas del 10 de diciembre de 1996 y Nº17553 de las 12:23 h. del 30 de noviembre de 2007 y de la misma Sala Constitucional, N.º 6880 de las 15:05 hrs. del 22 de mayo de 2013).
Así las cosas, al no recibirse prueba en la audiencia oral, ni ampliarse los fundamentos de los motivos contenidos en el libelo impugnaticio, a excepción de la contestación del Ministerio Público, el cambio de integración no acarrea perjuicio alguno a las partes. Esta Cámara, en todo caso, se impuso del contenido de la audiencia y transcribió en la resolución lo manifestado por todas las partes y se tuvo en cuenta al momento del dictado de la presente sentencia.
III.RECURSO DE APELACIÓN INTERPUESTO POR JORGE ENRIQUE PORRAS LEIVA, DEFENSOR DEL IMPUTADO [Nombre 001] Y APODERADO ESPECIAL JUDICIAL DE [Nombre 032] S.A., CONTRA LA SENTENCIA 107-2022 DE LAS 07:30 HORAS DEL 1 DE JULIO DE 2022 DICTADA POR EL TRIBUNAL PENAL DEL
Estos olvidos son propios de un juez desconcentrado y descuidado, que sumado a su inexperiencia como juez penal por ser juez 1, con apenas 6 meses de ser juez de juicio penal (inidóneo), no soportó el paso del tiempo y terminó por emitir un fallo ilegítimo". (folios 305 a 306).
(ii) No se analizaron ni describieron los documentos admitidos como prueba para mejor resolver (folio 244), los que analizados en conjunto con la demás prueba, se concluiría que la construcción que se le atribuye al imputado haber realizado, incluye edificaciones realizadas conforme a una Ley Forestal anterior a la que rige actualmente que disponía una limitación de cinco metros al área de protección del río, lo que no se analizó por la omisión dicha.
(ii) El juez simplificó lo anterior indicando que el encartado es autor del delito de invasión a una área de protección, procediendo a citar luego una sentencia de la Sala Tercera que se refería a un caso con condiciones distintas y sin que se pueda entender como dicha sentencia incide en la solución del caso que nos ocupa. El juez afirma que [Nombre 001] firmó actas (folio 41), pero se desconoce cuáles y cómo llegó a esa conclusión. (iii) La conclusión de la responsabilidad del imputado la deriva de la declaración de Josué Ruiz quien es socio comercial de [Nombre 011], hermano del imputado, con quien éste tiene una seria enemistad por problemas familiares, es decir, Josué sabiendo que resolvía asuntos del enemigo de su socio comercial (tienen un negocio juntos, ver página 13 de la sentencia), no se excusó de hacerlo. El otro testigo que confirmó la autoría de [Nombre 001] fue [Nombre 027], quien fue tratado por el juez como testigo sospechoso, quien según su declaración (folio 18 de la sentencia), para la fecha de los hechos el inmueble pertenecía registralmente al Banco Popular, tanto así que en el mes de setiembre de 2014 hizo declaración de bienes ante la Municipalidad de Nicoya y dijo bajo juramento que la propiedad le pertenecía a su representada, de modo que sin explicación alguna el Juez le creyó a estos testigos "desteñidos" y condenó a su representada.
(iv) A [Nombre 001] se le atribuyó en la acusación haber invadido una área de protección de aproximadamente 230 metros cuadrados, pero el testigo José Elías Benavides manifestó que lo que se invadía del área de protección y que no estaba construido conforme a la Ley (con 5 metros de zona de protección), era un alero de techo que no estaba adherido al suelo en el área prohibida, lo que es coherente con el informe ACT-OSRN-122-14 de folio 45 del expediente administrativo, admitido como prueba de que el mismo funcionario el 6 de agosto de 2014 recomendó la autorización para construcción en el sitio al constatar que no había invasión al área de protección del río. De lo anterior se concluye que un mes después de sucedidos los hechos, para el 14 de agosto de 2014, [Nombre 001] no había cometido ningún delito, sin que haya prueba que contradiga al funcionario, de quien no hay razón para dudar de su dicho, lo que el Juez no analizó ni se comprende por qué llegó a la conclusión de que para la fecha de los hechos el imputado cometió el delito, máxime que la siguiente inspección de verificación de los hechos, realizada el 30 de enero de 2015, más de 6 meses después de la primera, por lo que de ser ciertos los hechos sucedieron entre el 6 de agosto de 2014 y el 30 de enero de 2015 y no como lo derivó el Juez dejando por fuera prueba que analizar.
(v) Para la fecha de los hechos el Banco Popular era el titular de la propiedad, según la declaración de bienes que hizo [Nombre 027] y la propiedad se inscribió a nombre de [Nombre 032] S. A., hasta el 9 de setiembre de 2014 (folio 30), nada de lo cual se cuestionó el Juez. (vi) El expediente crediticio tampoco fue analizado de manera precisa por el juzgador en cuanto a que cuando se dio la venta a [Nombre 032] S. A., se encontraba en la finca una edificación que se mantiene en la actualidad, hecha de concreto, con perímetro delimitado de block y malla, es decir, lo que se atribuye al imputado que invadió, ya estaba construido para cuando el Banco Popular le vendió. El Juez no analizó en los peritajes de avalúo la descripción del inmueble a la hora de la venta, las fotografías que existen en el expediente, ni la descripción del inmueble, sino que solo analizó un peritaje forense que valoró el perímetro del área conforme a una ley posterior al momento que las edificaciones fueron construídas.
PRETENSIÓN: Declarar con lugar el recurso de apelación, anular la sentencia y ordenar el reenvío para nueva sustanciación.
En audiencia oral celebrada en el Tribunal de Apelación de Sentencia de Guanacaste, partir de las 10:05 horas del 14 de setiembre de 2002, el licenciado [Nombre 001] expuso de manera oral los fundamentos del recurso de apelación. Al respecto manifestó: La sentencia presenta vicios insalvables que le impiden adquirir eficacia. El primer argumento es la violación al principio de continuidad y concentración del debate. El juicio inició el 29 de abril de 2022 y la sentencia se dictó hasta el primero de junio de 2022, transcurrió más de un mes entre inicio y final. Un juicio con 3 testigos requirió de 5 audiencias, lo que sucedió fuera del marco estructural que establece el Código Procesal Penal, no se suspendió por causas que establece el Ordenamiento Jurídico, sino por problemas de agenda que señaló todas las continuaciones y se iniciaron a horas posteriores al señalamiento porque se señalaban a la misma hora juicios unipersonales con la misma integración.
Suspendía el juicio para continuar con otro, o iniciar uno nuevo a pesar de que se había señalado continuación todo el día. Esto provocó que el Tribunal no tuvo posibilidad de saber lo que estaba pasando. Al punto que uno de los motivos de apelación tuvo que ver con la preterición de prueba que se ofreció y admitió, y olvidó analizarla en la sentencia, prueba que afectaba esencialmente el marco acusatorio. Concretamente se ofreció prueba documental que demostraba que el Banco Popular ostentaba la posesión formal del terreno por ser el propietario registral, para el momento que suceden los hechos, la que constaba en el expediente municipal, se aceptó y luego no la analiza, dejando vacía la sentencia respecto del argumento que estratégicamente expuso la Defensa de que don [Nombre 001] no pudo ser autor de los hechos porque no era el dueño registral, y porque el Banco manifestó a través de una declaración jurada de bienes inmuebles, en fecha posterior a la que suceden los hechos, que el bien le pertenecía.
Esto se provoca por el efecto de la desconcentración en el juicio y al momento de valor los elementos de prueba sometidos a su escrutinio. Se impugna también la sentencia porque la prueba que se incorporó y que sí analizó el Juez, lo hace de manera incorrecta, pues omite analizar por qué en la fecha que se supone suceden los hechos, se presenta un funcionario del MINAE que hace una inspección y dice en el informe ACT-OSRN-122-14 de folio 45 que en el lugar no existía ninguna afectación ni construcción en el terreno que implicara una invasión de una área determinada. Esto deja en ascuas la fecha de los hechos acusados que según la acusación fue en el año 2014, en la primera quincena del mes de julio el funcionario del MINAE determina que no hay afectación, sino hasta un años después. Es decir, de ser ciertos los hechos sucedieron después de la Participación del MINAE y hasta un año después, fecha de la segunda valoración, es decir, no pudieron haber sucedido en la primera quincena de julio del 2014.
Fecha que está fuera de la pieza acusatoria, es decir, en la primera quincena del 2014 nunca pudieron haber sucedido esos hechos que fue como se acusó y el juez los tuvo por demostrados, a pesar de que la prueba documental establece otra cosa. El Juez no analiza que el propio MINAE establece que no existió, y a la fecha no existe, una afectación al patrimonio forestal ni al área de protección del Río Chimpazo, y que esto tiene como consecuencia que no existiría lesividad de la conducta. En cuanto a la restitución de las cosas a su estado original, toman en consideración aspectos que no fueron propios del juicio y dejan al descubierto aspectos que sí lo fueron. Cuando don [Nombre 001] adquirió esa propiedad antes de los hechos, ya existía tal cual la construcción que ordena el Juez demoler, construcción que se hizo con permisos de la Municipalidad y permisos del rector forestal. Ya estaba construido.
El Juez lo que tiene por demostrado es que a don [Nombre 001] se le atribuye la construcción, y no es una construcción porque ya también estaba construido de un muro en el límite de la propiedad, pero a la hora de la demolición ordena demoler todo, inclusive lo que ha estaba construido con una ley forestal que preveía no diez metros para el área de protección, sino cinco metros. No se consideró por el Juez la reforma de la Ley Forestal del 5 de mayo en relación al artículo 33 bis que permite obra civil en el área de protección para encausar aguas y que no afecte las obras ya construidas.
PRETENSIÓN: Se solicita la anulación del fallo y la disposición para que se discuta nuevamente.
IV.RECURSO DE APELACIÓN POR ADHESIÓN INTERPUESTO POR LICENCIADO VÍCTOR HUGO CASTRO CARTÍN, DEFENSOR DEL DEMANDADO CIVIL BANCO POPULAR Y DE DESARROLLO COMUNAL CONTRA LA SENTENCIA 107-2022 DE LAS 07:30 HORAS DEL 1 DE JULIO DE 2022 DICTADA POR EL TRIBUNAL PENAL DEL II CIRCUITO JUDICIAL DE GUANACASTE, SEDE NICOYA.
ÚNICO MOTIVO: inconformidad con lo resuelto de restituir las cosas a su estado original. El motivo se justifica de la siguiente manera: (i) Del informe ACT-OSRN-605-2018 de folio 60 se colige que en el inmueble en litigio, existía antes de los hechos acusados una construcción realizada conforme a la Ley Forestal vigente que establecía un área de protección de 5 metros de la margen del río y contó con los permisos correspondientes. (ii) No se ha aportado prueba alguna que acredite cuál es la porción de las obras que se encuentran actualmente edificadas que debe considerarse como construcción nueva o ampliación, por concepto de lo cual se estableció el presente proceso. (iii) Es improcedente y contrario a Derecho que se ordene la demolición de obras, ya que ello solo procedería en relación a lo construido en la fecha de los hechos acusados, lo cual es imposible material y legalmente determinarlo, pues no hay pruebas que permitan diferenciar entre las obras preexistentes y las nuevas. (iv) Se produce gran afectación al Banco Popular al ordenar el derribo de la total construcción, conforme a la Ley Forestal actual, por la pérdida de valor de la propiedad dada en garantía de crédito.
PRETENSIÓN: Se declare con lugar el recurso de apelación y parcialmente ineficaz la sentencia recurrida únicamente en cuanto se ordenó la restitución de las cosas a su estado anterior y se ordene la reposición de la resolución.
En audiencia oral celebrada en el Tribunal de Apelación de Sentencia de Guanacaste, partir de las 10:05 horas del 14 de setiembre de 2002, el licenciado Castro Cartín expuso que el recurso de adhesión lo era respecto de lo resuelto sobre la restitución de las cosas al estado original. Refirió que al momento del dictado de esa parte de la sentencia se inobservaron las reglas de la sana crítica respecto de la apreciación de los elementos probatorios de valor decisivo. Se ordenó la restitución de las cosas al estado anterior sin haberse determinado cual era ese estado anterior. Había una propiedad en la que existía una determinada construcción que fue hecha conforme a la legislación forestal vigente al momento de su edificación, y posteriormente se dan los hechos que aquí se conocen, que se trató de una edificación o ampliación ajena o aparte a la construcción existente y que según la tesis acusatoria es la que produciría la actividad delictiva por invasión al área de protección.
El detalle es que existe una indeterminación de cuáles son esas obras desarrolladas en infracción a la Ley Forestal. El Banco Popular tiene una propiedad adjudicada que es la [Valor 003], lo que consta en el expediente administrativo aportado a los autos. La propiedad no tenía gravámenes, está inscrita, con plano catastrado que indicaba que dentro de la propiedad había un restaurante (folios 86, 90, 104, 105, 106 del expediente administrativo). Don [Nombre 001] manifestó interés en adquirir la propiedad en el estado que se encuentra. Se hizo avalúo que contempla crédito para la realización de mejoras a la infraestructura existente, como mejoras a la instalación eléctrica, pintura, cambiar parte del techo, términos en los que se aprobó el crédito, todo lo cual consta en el inmueble. En el expediente principal a folio 159 y 179 está la escritura pública donde consta que el 14 de octubre de 2014 se dio la venta.
El mismo día de la venta como lo declaró el testigo [Nombre 027], don [Nombre 001] tomó posesión del inmueble. La compra se hizo a través de una sociedad anónima de la cual don [Nombre 001] era el representante. Mediante la testimonial se sabe que el mismo día de la escritura o a lo sumo al día siguiente se tomó la posesión del inmueble. Hasta ese punto hay una propiedad con una construcción y que todo está en regla. Posterior a esto se empiezan a realizar ampliaciones que fueron detectadas por la Municipalidad que hizo unas inspecciones y detectan, a partir del 21 de julio de 2014, no solo las obras de las instalaciones eléctricas y demás, sino además una ampliación que no estaba dentro del plan original, y que se realizaron sin los permisos de construcción. A raíz de esto se paralizaron las obras y se realizó un informe y croquis que consta a folio 25 del expediente administrativo aportado por la Municipalidad, según inspección realizada el 24 de setiembre de 2014 que nos dice que ya hay una ampliación, una área de ampliación, una área nueva, totalmente aparte de la construcción ya realizada que es la que en buena teoría está invadiendo el área de protección.
En esos términos, y con la tesis de que puede tratarse de una conducta totalmente delictiva, se encuentran dentro del octubre de 2014 (se citan otros documentos pero no se logra entender bien), todas van en la misma dirección de que hay una invasión a una área de protección de aproximadamente 101 metros cuadrados, ampliación que no existía en el (no se entiende). Desde esa perspectiva se le da la información al Ministerio Público y en la denuncia consta que esa ampliación de 101 metros cuadrados no existía en el edificio original. En buena teoría debería enfocarse las actuaciones e investigaciones en determinar si estas ampliaciones, estas obras nuevas eran o no objeto de un delito. A la hora de iniciarse la investigación, como consta en el dictamen pericial de folios 25 a 27, donde se solicitó determinar si la construcción invade una área de protección, no las obras nuevas, no la construcción nueva, sino la construcción en general.
Partiendo de esa premisa, los peritos dan un dictamen donde ya no habla de 101 metros, sino de que hay una invasión aproximadamente 240 metros cuadrados, generándose un nuevo panorama y una duda por indeterminación de cuál es el área objeto del proceso. Si observamos la acusación, al igual que la querella y la acción civil parten de que la invasión se dio por 240 metros cuadrados que los dividen en tres partes: 44 metros cuadrados de acera, 67 metros cuadrados de parqueo y 129 de bodega. Si observamos el croquis de folio 27 fte y vlto se observa que la línea que trazan los peritos se mete totalmente dentro de la construcción vieja y no diferencia con la construcción nueva. La línea pasa por la mitad o un tercio de toda la bodega. Desde esa perspectiva hay una indeterminación de cuáles son los hechos y cuál es la construcción que se debe derribar. Para ir más allá, a folio 59 y 60 consta el oficio ACT-OSRN-605-2018 que es la valoración del daño ambiental donde se indica a folio 60 que lo que se hizo fue una pared de 16 metros de largo por 4 de alto con techo y estructura de perling, invadiendo un área de 44 metros cuadrados sobre el límite de la propiedad donde antes se ubicaba una malla tipo ciclón, menciona que ya existía una construcción.
La Municipalidad hablaba de 101 metros cuadrados, los compañeros del Poder Judicial de 240 metros cuadrados y al valorar el daño ambiental se habla de 44 metros cuadrados. En ese panorama de indeterminación del área afectada se procede al dictado de la sentencia. Todo esto se señaló en las conclusiones, indicándose que no había fundamento claro para el dictado de la sentencia en la que se ordena la restitución de las cosas a su estado original según lo indicado en la ampliación del dictamen pericial, que es el que habla de 240 metros y que considera la totalidad de las construcciones. Desde esa perspectiva se está ordenando demoler no solo la ampliación, que es lo que corresponde a la presunta actividad delictiva, sino también una tercera parte de lo construido que es garantía de la operación que se otorgó por 71 millones de colones.
PRETENSIÓN: Solicitamos la ineficacia de la resolución en cuanto ordenó la restitución de las cosas y se ordene la reposición en cuanto a ese extremo.
Entre las suspensiones no se irrespetó el plazo de los 10 días. Hay que tomar en cuenta que las agendas de los tribunales están saturadas y se requieren suspensiones. Se entrevistaron varios testigos y se incluye al imputado, lo que vino a justificar las suspensiones y que el juicio tardara alrededor de un mes. De la lectura de la sentencia se concluye que no se generó ni un mínimo agravio según la incidencia que él plantea. La técnica del Defensor es hacer énfasis en algunos documentos, pero ignora la globalidad de la prueba que es lo que el Tribunal ha hecho de forma correcta. No solo se tienen los dictámenes del SINAC que de alguna manera vienen a acreditar la invasión del imputado a la zona de protección. Lo mismo señalado por el señor del Banco Popular, tenemos claridad que en el 2014, que es lo que el Defensor señala como agravio de que según la acusación los hechos ocurren en el 2014, pero que en realidad ocurren mucho posterior y que no hay correlación entre lo que se acusa y lo que se acredita.
Si se analizan otros documentos se puede verificar que el préstamo que a él se le otorga es para construir obra en esta propiedad, y es esa construcción la que genera invasión en la zona de protección del río que acá nos ocupa, invasión de la que no hay duda a partir de un análisis global de la prueba. Hay pericias. El imputado en su declaración dijo que la Municipalidad la tiene contra él y que hay una persecución, pero como no va a estar pendiente la Municipalidad de la construcción que él está realizando si nunca gestionó el permiso y las obras se realizan a 150 metros de distancia de la Municipalidad. De haber tramitado los permisos se habría orientado de dónde tenía que construir y no hacer las edificaciones a la brava con el inconveniente de la invasión que abarca tres edificaciones: parqueo, acera y bodega, todo acreditado con los testimonios de funcionarios municipales y funcionarios del SINAC, quienes detallaron que en las inspecciones el encargado del sitio era el imputado, quien los atendía y a veces de mala gana.
Sobre la restitución. El agua no es recurso inagotable y se protege el área que cubre esos recursos, de manera atinada y conforme a pericias topográficas que establecen las áreas que invaden los 10 metros debe ser demolido porque invade ese sector. El principio in dubio pro natura, faculta al juez en caso de que exista duda con respecto a edificaciones ya existentes, que se favorezca a la naturaleza, el río.
PRETENSIÓN: Se mantenga el fallo en todos sus extremos rechazando ambos recursos de apelación. En el caso de Banco Popular no tiene legitimación como lo hizo ver la representante de la Procuraduría.
(iii) Los permisos municipales de construcción número 547-2009 para paredes covitec y 012-2011 para baños para discapacitados y remodelación de pared que fueron otorgados muchos años antes de la fecha de los hechos acusados del año 2014 y dados al señor [Nombre 012], cuyas estructuras no se encuentran atribuidas al endilgado, a quien se le atribuye como construcciones ilegales una área de acera de concreto que invade 44 metros cuadrados del área de protección, un parqueo de concreto que invade 67 metros cuadrados del área de protección y una bodega de concreto que invade 129 metros cuadrados del área de protección, lo que no tiene ninguna relación con los citados permisos que se alegó fueron inobservados por el juzgador. (iv) En relación al tercer motivo, el testigo José Luis Guerrero, funcionario municipal, declaró que al endilgado se le ordenó en tres ocasiones la paralización de las obras que invaden el área de protección que consistían en la ampliación de una estructura ya existente.
Dichas órdenes fueron giradas por el imputado como representante de la propietaria del inmueble, ya que cuando el funcionario consultó a los empleados, le informaron que el dueño era el imputado y él se apersonó al lugar, insultó a los funcionarios y le dijo a los peones que continuaran. El testigo también informó que la propiedad estaba a nombre de [Nombre 032] S. A. y que el imputado era su representante legal, lo que se confirma con la respectiva certificación registral de la propietaria de la finca y de los nombramientos de la junta directiva, con lo cual se demuestra que para la fecha de los hechos el imputado ostentaba la representación judicial y extrajudicial, como presidente con facultades de apoderado generalísimo sin límite de suma, de igual manera consta en el enemistad entre [Nombre 011], socio del testigo Josué Ruiz Guerrero y el imputado nunca se acreditó ni es relevante porque la prueba documental y testimonial demuestran que las construcciones que él imputado ordenó se ubican en el área de protección del Río Chimpazo y no cuentan con permisos.
(vi) El testigo [Nombre 027] informó sobre la relación comercial entre el Banco Popular y el imputado manifestando que una vez firmada la escritura éste entró en posesión del inmueble e inició las labores de construcción, lo cual es coincidente con el oficio DRI-02-0559-2021 emitido por el Registro Nacional en el que consta que si bien en el mes de julio de 2014 el titular registral de la finca de Guanacaste [Valor 003] era el Banco Popular, desde el 8 de julio se otorgó escritura de compra venta a favor de [Nombre 032] S. A., lo cual se anotó en el Registro hasta el 09 de setiembre de 2014, por lo que, quien tenía el dominio del inmueble para la fecha de los hechos era el imputado. (vii) De los peritajes de avalúo del inmueble del propiedad ya existía una construcción, pero ese no es el hecho ilícito, sino las ampliaciones efectuadas por el endilgado cuando adquirió la propiedad, en el área de protección del río, según dictamen pericial DCF:2018-00896-ING elaborado por el Organismo de Investigación Judicial.
(viii) No puede permitirse la permanencia de las edificaciones en aras de los principios pro natura y de irreductibilidad del bosque, lo que se debe ordenar aún de oficio e incluso en sentencias absolutorias (voto 2014-1528 del Tribunal de Apelación Penal de Cartago; 2007-964 del Tribunal de Casación Penal del Segundo Circuito Judicial de San José y voto 2007-507 del Tribunal de Casación Penal de San Ramón. Por lo anterior, la medida de restitución de las cosas a su estado original se adecua a máximas constitucionales destinadas a la protección del ambiente. (ix) La sociedad [Nombre 032] S. A., debe responder en forma solidaria con el daño ambiental causado, por ser la propietaria del inmueble y porque el imputado era su representante legal, según lo establece el numeral 57 de la Ley Forestal.
PRETENSIÓN: que se declare sin lugar el recurso de apelación.
En audiencia oral celebrada en el Tribunal de Apelación de Sentencia de Guanacaste, partir de las 10:05 horas del 14 de setiembre de 2002, la licenciada Zaray Chavarría manifestó: Pido que la sentencia se mantenga incólume porque cumple con los presupuestos de hecho y Derecho. Se tiene por acreditado que el imputado era el que tenía la posesión material del inmueble. Hay una certificación registral en la que se establece que para el momento de los hechos el representante judicial y extrajudicial era el imputado, por lo que tenía el domino sobre el bien. Igualmente se establece que el propietario es (no se entiende), También hay certificación que acredita que si bien el inmueble estaba inscrito a nombre del Banco Popular, lo cierto del caso es que la fecha de la escritura de traspaso se dio para la fecha de los hechos y que según el testigo, quien firmó la escritura fue el imputado. Igualmente los funcionarios de la Municipalidad determinaron a través de los trabajadores de la construcción que quien estaba a cargo de los obras era el imputado, quien se presentó a la construcción y le notificaron la orden de paralización y él continúa, por lo que es culpable de los hechos que se le están atribuyendo.
En cuanto a la reforma de la Ley Forestal a que hizo referencia el Defensor que el Juez inobservó, se establecen cuales son los presupuestos y en ninguno de ellos se encuentran las construcciones que están invadiendo, por lo que se debe mantener la orden de demolición. En cuanto al recurso que planteó el señor del Banco Popular, no fue al Banco al que se le ordenó realizar la demolición, ni la propiedad está a nombre del Banco, y lo que se considera es que si el imputado deja de cancelar, ese es un riesgo que asumió el Banco, al otorgar el crédito (no se entiende), por lo que el agravio no viene a ser más que una expectativa y no un agravio real. En cuanto al monto de indemnización por la acción civil resarcitoria, hay un documento del SINAC que establece el monto y no fue desacreditado y es con base en él que el Juez condena al pago (,,,). Se solicita se mantenga incólume la resolución.
De las actas del debate se desprende que el mismo inició el 29 de abril de 2022 a las 08:16 horas. Esa primera audiencia concluyó a las 11:51 horas. A pesar de que era posible continuar con la recepción del testigo [Nombre 027], la Defensa se opuso alegando que prefería que se evacuara de previo la prueba de cargo (folio 240), para la continuación de debate se ordenó la presentación del testigo José Elías Benavides Fajardo (folio 245). El debate continuó el 10 de mayo de 2022 a las 08:20 horas y la audiencia respectiva concluyó a las 09:58 horas, en dicha oportunidad no se pudo recibir el testimonio del señor [Nombre 027] y la Defensa se opuso a variar el orden de la prueba para incorporar la documental. Se convocó para continuación el día 23 de mayo de 2022 a las 08:00 horas. A las 08:27 horas del 2 de mayo continuó el debate, oportunidad en la que evacuó el testimonio del señor [Nombre 027] y se incorporó la prueba documental.
A las 12:40 horas concluyó la audiencia y las partes fueron convocadas para las 08:00 horas del 31 de mayo de 2022 (folios 263 y 269). En la audiencia anterior, que fue la última, las partes emitieron sus conclusiones y se dio por finalizado el debate. De la cronología anterior se determina que ninguna de las suspensiones del debate superó el plazo de diez días hábiles a que hace referencia el primer párrafo del numeral 336 del Código Procesal Penal. A excepción de la última suspensión, las demás tuvieron amparo en lo previsto en el inciso c) del artículo 336 del Código Procesal Penal, es decir, por no haber comparecido testigos al debate o bien porque habiendo prueba testimonial pendiente de evacuar, la Defensa Técnica se opuso a la modificación del orden de recepción de la prueba. En la última suspensión no constan las razones por las que no se procedió en la segunda audiencia con la fase de conclusiones, sin embargo no consta protesta alguna de las partes, entre ellas la Defensa Técnica, para que dicha suspensión no se diera, y en todo caso no encuentra esta Cámara con que esa única suspensión tenga la virtud de provocar la ineficacia de la sentencia, máxime que como se verá de seguido, no produjo en la persona juzgadora las consecuencias que alegó el recurrente de que el Juez no pudo mantener la identidad de lo sucedido en el debate al momento de dictar sentencia.
Si bien es cierto que a folio 9 se consignó como nombre del imputado [Nombre 007], ello, en el contexto de la totalidad de la sentencia en la que el nombre del imputado se consignó de manera correcta, evidencia que se trató de un simple error material. En relación al tema de la demolición de la construcción, como se verá al pronunciarnos en relación al cuarto motivo, tampoco incurrió la persona juzgadora en error alguno ni omitió valorar prueba esencial al respecto, como se alegó en el primer motivo.
Efectivamente, tal y como lo alegó el recurrente, la citada prueba no fue analizada ni valorada en la sentencia, siendo que la misma fue admitida según se desprende del acta de folio 248. Se trata de una certificación en la que consta informe de con fecha 30 de junio de 2021 relacionado con la finca [Valor 003] que corresponde al inmueble objeto del presente litigio, en el que se otorgaron dos permisos de construcción de dos baños y remodelación de pared, permisos que data de los años 2009 y 2011, finca en la que además, por las declaraciones de bienes se logró identificar una edificación de más de 20 años de existencia (cfr. folios 246 a 249). De acuerdo con el artículo 184 del Código Procesal Penal, el Juez no tiene la obligación de valorar toda la prueba evacuada en el debate al momento de dictar sentencia, sino solo aquella que resulte esencial: "El Tribunal asignará el valor correspondiente a cada uno de los elementos de prueba, con aplicación estricta de las reglas de la sana crítica.
Debe justificar y fundamentar, adecuadamente, las razones por las cuales les otorga determinado valor, con base en la apreciación conjunta y armónica de toda la prueba esencial ". La prueba que cita la recurrente, en criterio de esta Cámara, carece de esencialidad porque hace referencia a una construcción que dejó de existir porque fue demolida en su totalidad. Desde la primera acta de paralización de construcciones visible a folio 1 del expediente administrativo de la Municipalidad de Nicoya se hace referencia en las observaciones a lo siguiente: "incumple artículos 79, 84 y 92 de la Ley 883 y también incumple con el artículo 33 de la Ley 7575. Se trata de la demolición del antiguo Bar Happy para la reconstrucción de una bodega con dimensiones aproximadas de 16,5 metros por 23 metros". Si se observan las fotografías de folios 2 y 7 a 10 se concluye fácilmente que se observan vestigios de la construcción anterior, entre ellos una malla, fuera de la cual también se puede observar que se están construyendo tres columnas, malla que también fue demolida posteriormente.
Ninguna relevancia por lo anterior tiene en el presente proceso la acreditación de una construcción preexistente que fue demolida, es decir, dejó de existir, para en su lugar levantar una nueva. La nueva construcción que según se demostró -conforme se analizará en los acápites siguientes- se inició en la primera quincena de julio de 2014, indudablemente tenía que contar con los respectivos permisos municipales, pero además debía respetar la zona de protección de diez metros de la orilla del Río Chipanzo, conforme lo establecía en aquel momento, y lo hace en la actualidad el numeral 33 de la Ley Forestal número 7575, vigente desde el 16 de abril de 1996. Si bien lleva razón el recurrente al señalar que la Ley Forestal anterior, que era la número 4465 vigente desde el año 1969, en el artículo 84 disponía una área de protección de 5 metros en ambas riveras de los ríos, disposición que se mantuvo vigente hasta la reforma de la Ley Forestal introducida por la Ley número 7174 vigente desde el 16 de julio de 1990.
En dicha reforma de la Ley 4465 se modificó el área de protección a 10 metros de la rivera de los ríos, tal y como constaba en el numeral 68 de la Ley Forestal 4465 después de la citada reforma, disposición que se mantuvo vigente hasta su derogatoria por la Ley Forestal 7575 hasta el 16 de abril de 1996. De acuerdo con lo anterior, si la edificación que existía en la finca de [Nombre 032] S. A., al momento de su adquisición había sido realizada antes de la vigencia de la Ley 7174, es decir antes del 16 de julio de 1990, solamente debía respetar una zona de protección respecto del Río Chipanzo de 5 metros, sin embargo, lo anterior no fue comprobado de esa manera, porque el 30 de junio de 2021 se hace referencia a una edificación con una antigüedad de más de veinte años, cuando para esa fecha la vigencia de la reforma a la Ley Forestal que modificó el área de protección en los términos supra indicados estaba por cumplir 31 años de vigencia.
Es decir, la prueba no valorada por el Juez y que fundamenta el motivo de preterición de prueba, no permite tener por demostrado con certeza que la construcción preexistente a que se hace referencia se realizó antes del 16 de julio de 1990, por lo que carece de esencialidad y su no consideración en la sentencia no produjo agravio alguno. En todo caso la discusión tendría relevancia si la construcción preexistente a la que se hace referencia en el motivo de apelación se mantuviera en la actualidad, pero como ya se adelantó, la misma fue demolida y se construyó una nueva que tuvo que haberse realizado respetando la zona de protección del Río Chipanzo, conforme a la Ley Forestal vigente desde el 16 de abril de 1996.
Tal hecho de la representación antes referido, así se consignó en la descripción fáctica de la acusación particular, es decir, que durante dicho tiempo el justiciable tenía facultades legales para realizar el proceso constructivo que se le atribuyó. Independientemente de la formalidad de ser el encartado apoderado o no de una persona jurídica titular del inmueble donde se realizó la construcción que invadió la zona de protección del Río Chipanzo, lo cierto es que también se demostró que el encartado era el encargado de las obras que se realizaron en la finca de su representada. En ese sentido consta en la sentencia no solo la verificación de la invasión a la zona de protección del Río Chipanzo a que se hace referencia en la acusación y la querella, sino la participación del imputado como autor de las mismas. Al respecto consta en la fundamentación intelectiva lo siguiente: "Como conclusión del análisis realizado por este Tribunal, a la luz de las reglas de las sana crítica racional, reglas de la lógica y la experiencia, y de conformidad a la prueba recibida en las audiencia oral y pública de juicio, se arriba a la conclusión de que se puede tener por acreditada la especie fáctica acusada y querellada, constitutiva de un delito de Infracción a la Ley Forestal, en su modalidad de Invasión a un Área de Protección.
La prueba testimonial que se recibió en juicio, consiste en la declaración de JOSUÉ RUÍZ GUERRERO , quien era funcionario del Departamento de Control Constructivo y Obra Pública de la Municipalidad de Nicoya, para el momento de los hechos, además fue responsable de la elaboración de la DENUNCIA IM-220-2015 (folios 1 a 7) , en la que se describen los hechos objeto de investigación, específicamente la inspección que realizó a una construcción ilegal, ubicada en Nicoya, cincuenta metros oeste de las oficinas del Periódico la Voz de Guanacaste, en el antiguo Bar Happy, se indica que esta era una construcción ilegal porque la misma no contaba con permisos Municipales de construcción, ya que según lo indicado por el testigo en el debate, al presentarse al lugar donde se realizaba la obra, pudo constatar que la construcción carecía de dichos permisos, además de esto, pudo verificar el señor Josué, que la ampliación de la construcción, realizada en la parte este de la propiedad, estaba invadiendo la zona de protección del Río Chipanzo.
(...) El día de la primer visita por parte del testigo quien para ese momento era funcionario Municipal, fue el 21 de julio del 2014, al consultarle el señor Ruiz a las personas trabajadoras que realizaban la construcción por el dueño y encargado de las obras, los trabajadores procedieron a llamar al señor imputado [Nombre 001] , quien se apersonó al lugar, el testigo procedió a notificarle sobre su incumplimiento de permisos Municipales, en ese momento se realizó una primera paralización de la construcción, según consta en el acta de paralización de construcciones, visible en el folio 01 de las copias del expediente administrativo, consta en dicho folio la firma del señor imputado como la persona a la cual se le notificó como propietario y encargado de las obras. Detalla el testigo que para el día 21 de julio del 2014, las obras tenían un avance del veinte por ciento, según se logra observar en las fotografías que constan en el folio 02 de las copias del expediente administrativo, en dichas fotografías se observa claramente la construcción de tres columnas de block de cemento y perling metálicos.
Esta información también fue verificada en juicio por el testigo JESUS ALBERTO ABADIA VARGAS, quien pese a que no recordó mayor detalle de los hechos si logró indicar de manera espontánea que se apersonó a la propiedad donde antes existía el Bar Happy, para ese momento él era funcionario Municipal, indica el testigo que lo que recuerda era que habían personas construyendo columnas hechas de block de cemento. El día 21 de julio del 2014, además de paralizar las obras del encartado se le otorgó un plazo de treinta días para presentarse a la Municipalidad, a efecto de cumplir con los requisitos necesarios de su construcción, además se le hizo la indicación de que de no cumplir se procedería con la demolición de las obras. El señor [Nombre 001] haciendo caso omiso a las prevenciones realizadas, continuó con las obras, así consta en el acta de las once horas del día 19 de setiembre del 2014, información que vino a ratificar en el contradictorio el testigo Ruíz Guerrero mencionó que ese día nuevamente revisaron la construcción y pudieron constatar que habían finalizado la misma, esta información se logra verificar con la secuencia fotográfica visible en las copias del expediente administrativo folios del 07 al 10, en esta se logra apreciar, como en el lugar donde había una malla tipo ciclón y tres columnas hechas de block de cemento, se encontraban construídas más columnas de cemento totalmente finalizadas, una pared de cemento completamente terminada, y la malla fue retirada del lugar, está construcción se ubica en el lado este de la finca, paralela al río Chipanzo, toda la estructura del techo de este edificio también estaba completamente terminada, por esta razón, nuevamente los personeros de la Municipalidad de Nicoya, realizaron la clausura de las obras.
Una vez clausurada la obra las personas que trabajaban en la construcción llamaron al encartado, el señor [Nombre 001] nuevamente se presentó al lugar, se le indicó que tenía que detener la obra y no podía continuar con la misma hasta que se pusiera al día, [Nombre 001] echó del lugar a los empleados municipales incluido el testigo Josué, quien mencionó que el endilgado fue un poco violento, después de esto, el señor [Nombre 001] le dio la orden a los trabajadores de seguir con sus labores. Continua indicando el testigo que [Nombre 001] tenía en posesión este inmueble, el cual está a nombre de una Sociedad, verificaron esta información en el registro y [Nombre 001] figuraba como representante legal, indica que la Sociedad se llama [Nombre 032], el señor [Nombre 001] no quiso parar su proceso de construcción, les indicó que iba a seguir adelante. Este testigo, rindió en juicio una declaración clara con la narración de lo que conoció en razón del ejercicio de sus cargos, detallando las circunstancias de modo, tiempo y lugar en que se suscitaron los hechos imputados a [Nombre 001], según la visita que realizaron al lugar de los hechos, el testigo fue claro al indicar que la construcción no tenía los permisos respectivos y estaba invadiendo el área de protección del Río Chipanzo.
Este testimonio encuentran respaldo en la prueba documental que fue incorporada válidamente al proceso y que aporta para efectos de valoración, datos importantes que son vitales para tener por acreditada la comisión del delito que se investigó. También se contó en el debate con el testimonio del señor [Nombre 023], este testigo menciona que él fue funcionario del SINAC, desde el 2007 hasta el 2019, hace referencia que el área de protección para el cause de un río en zona urba es de diez metros, la propiedad de la Sociedad [Nombre 032] S.A, la cual para el momento de los hechos era representada por el encartado se encuentra en zona urba por lo que debe respetar diez metros de distancia, esto es con la finalidad de que el río se pueda desplazar y crecer cuando aumente su cause; referente al caso en concreto, menciona que debido a una denuncia que ingresó el día 29 de julio del 2014, se le encargó la medición del área de protección del río Chipanzo, en un terreno que se ubica en Nicoya, de la Municipalidad, carretera al Estadio, del puentecito que está ahí, el día 06 de agosto del 2014, se apersonó a la propiedad mencionada, agrega que sabía que era propiedad de [Nombre 001] porque después se dio cuenta que era de este señor quien representa la verdulería Sammy, al presentare al lugar pudo constatar que la construcción que realizaban en este inmueble estaba invadiendo el área de protección, menciona que se estaban construyendo perlings y un alero en dirección al río, estos los sacaron de una pared vieja que ya existía, se les indicó a los constructores que no debían hacer estas obras, los mismo mencionaron tener los respectivos permisos, pero nunca los mostraron, el testigo procedió a realizar la mediciones correspondientes y en la parte posterior de la propiedad se estableció que la misma estaba a cuatro metros con cuarenta centímetros del río, al centro de la propiedad a tres metros del río y al frente de la propiedad a seis punto veinte centímetros del cause del río Chipanzo, al respecto de esta información brindada por el testigo en el debate se cuenta con el documento de prueba, informe ACT-OSRN-247-2015, en el cual también consta una segunda visita realizada por el testigo a la construcción en fecha 29 de enero del 2015, esto a petición del departamento de Gestión Ambiental de la Municipalidad de Nicoya, en dicha visita nuevamente se establece que hay un pared invadiendo el área de protección del Río Chipanzo, se volvió a tomar las medidas, las cuales dieron exactamente igual a las de la primera visita, por lo que nuevamente se logró establecer que existía una invasión al área de protección.
Los testigos de cargo, fueron amplios en sus respuestas a las partes durante el contradictorio, brindaron los detalles que les fueron solicitados y no se denotó la existencia de algún indicio (mucho menos, prueba) de que pretendieran relacionar al imputado con un delito por el mero deseo de perjudicarlo. Se trata de dos testigos idóneos y capacitados en sus funciones para abordar una investigación por un presunto delito de infracción a la Ley Forestal. Cada uno de los testigos de cargo, rindió una declaración que denota la fortaleza para mantener la narración de las diligencias que llevaron a cabo, mostrando sinceridad en cuanto al detalle de lo que cada uno de ellos, pudo observar o realizar, en apego a la división de funciones que tuvieron en el desarrollo de la investigación dentro de la causa que nos ocupa. No existe vestigio alguno de mendacidad en sus declaraciones, manteniéndose ambos, contestes con lo consignado.
La información brindada por los citados testigos es conteste con los documentos probatorios del proceso, por ejemplo se cuenta con el Informe número 115-DM-SDRN-18, de fecha 26 de marzo del 2018, elaborado por el Organismo de Investigación Judicial de Nicoya, donde consta que los investigadores Wilmar Pérez Bermúdez y Freddy Porras Morales, quienes después de conversar con el testigo Josué Ruíz Guerrero, este les informó que la Municipalidad no ha otorgado permiso alguno de construcción al señor [Nombre 001], quien adquirió la propiedad al Banco Popular y posterior a esto procedió a realizar las obras de remodelación en este edificio, además de esto les mencionó el señor Ruíz Guerrero que la construcción está dentro de la zona protegida del río Chipanzo, los investigadores se desplazaron al lugar específicamente en Nicoya, Barrio Chorotega, de la Municipalidad de Nicoya, cien metros al sur y cien metros al oeste, lugar donde efectivamente los investigadores ubicaron una construcción al lado izquierdo de la vía, después del puente, en la ubicación del lado este de la construcción, se ubica una pared construida de forma paralela con el río Chipanzo, del margen del caudal del río a la pared se observa una distancia de dos metros con cuarenta centímetros.
Esta información fue ratificada también con el Acta de Inspección, Registro y Recolección de Indicios del Organismo de Investigación Judicial de Nicoya, número IO-SRDN-17, en la cual los citados investigadores hacen constar que al presentarse al lugar logran ver un edificio para el uso de local comercial, al momento de la visita no se observa actividad comercial en el interior, la construcción tiene al norte la calle pública, con un frente aproximado de dieciocho metros por treinta y cinco centímetros de fondo, al lado este de la propiedad colinda con el río Chipanzo, con una distancia desde el cauce del mismo hasta la pared del edificio de dos metros con cuarenta centímetros, se adjuntan dos fotografías del local. Aunado a lo anterior, se cuenta con la siguiente prueba de carácter técnico: a) Informe DA-UHTPNOL-0455-2018, del Ministerio de Ambiente y Energía, Dirección de Agua, Informe en el que se detalla por parte de dos ingenieros de la Unidad Hidrológica Tempisque Pacífico Norte, los resultados de la inspección al sitio, logrando determinar estos profesionales, que se ubicó al lado este de la Finca del Partido de Guanacaste, matricula número [Valor 003] , el río Chipanzo de carácter permanente , cuyo cause es de dominio público. b) Dictamen Pericial 2018-896-ING, realizado por la Sección de Ingeniería Forense del Organismo de Investigación Judicial, este dictamen fue realizado por el perito judicial 2, Álvaro Mauricio Rojas Porras, en dicho documento se logró determinar que la construcción ubicada en Guanacaste, Nicoya, coordenadas geográficas latitud norte: 10 grados 08 minutos 26.7 segundos, longitud oeste: 85 grados, 27 minutos, 16.2, en esta diligencia estuvo presente el imputado [Nombre 001].
Se realizó medición topográfica con estación total, de la rivera del río, punto de referencia puente y de la edificación denunciada, la construcción se ubica en un sector urbano, por lo que se aplicó un retiro de protección de diez metros, dando como resultado que se encuentra dentro del área de protección una acera la cual invade cuarenta y cuatro metros cuadrados el área de protección del río Chipanzo; una zona de parqueo la cual invade sesenta y siete metros cuadrados de construcción el área de protección y una edificación la cual invade ciento veintinueve metros el área de protección del mencionado río. c) Informe Técnico de Valoración del Daño Ambiental ocasionado en el área de protección INFORME TÉCNICO ACT-OSRN-605-2018, elaborado por el Ministerio de Ambiente Energía y Telecomunicaciones, Sistema Nacional de Áreas de Conservación, Área de Conservación Tempisque; folios 59 a 60, este informe técnico fue realizado por el señor [Nombre 024] y [Nombre 025], mediante la visita de campo realizada a la propiedad que se ubica en [Nombre 026], el día 28 de julio del 2014, en el cual se estimó el valor del daño ambiental estimado para las obras realizadas por el encartado en el área de protección del río Chipanzo, en la suma de CUATRO MILLONES CUATROCIENTOS MIL COLONES EXACTOS.
En cuanto al primer hecho probado de esta sentencia, no existe duda alguna ni fue controvertido que la finca del Partido de Guanacaste, matricula número [Valor 003] , plano catastrado número [Valor 006], es propiedad de [Nombre 032] de Nicoya Sociedad Anónima, cédula jurídica [Valor 004] , a partir del ocho de julio del 2014, fecha en que dicha Sociedad compra al Banco Popular y de Desarrollo Comunal, el citado bien inmueble, mediante el testimonio de escritura otorgado a las nueve horas del citado día, y presentado ante el Registro Inmobiliario el día 25 de agosto del 2014, según [...], mismo que se inscribió debidamente el día 09 de setiembre del 2014. Esta información se puede constatar de la Certificación de Movimientos Registrales Históricos del Registro Inmobiliario, Departamento de Asesoría Jurídica, realizado por el licenciado Diiter Chaves Gehring. Es importante destacar en cuanto al segundo hecho que se tiene por probado en esta sentencia, que no existe duda alguna para este Tribunal que para la primer quincena del mes de julio del 2014, en la propiedad descrita en el anterior párrafo, el acusado [Nombre 001] , conociendo la ilicitud de sus actos invadió el área de protección del río Chipanzo, ya que construyó una acera de concreto que invade 44 metros cuadrados el área de protección, además un parqueo de concreto que invade 67 metros cuadrados el área de protección y una bodega de concreto que invade 129 metros cuadrados de área de protección.
Como tesis de defensa se plantea que, cuando da inicio la investigación, [Nombre 001] ya no era representante de la Sociedad que invade la zona protegida, además de no haberse demostrar que el encartado era quien estaba construyendo en el inmueble, por estos motivos alega la defensa que no se puede condenar al imputado [Nombre 001]. Estos argumentos no se sostienen probatoriamente porque en primer lugar, según se desprende del Expediente Administrativo del Banco Popular y de Desarrollo Comunal, (el cual fue aportado como prueba para mejor proveer por la defensa técnica), del testimonio de la escritura pública otorgada en San José, a las nueve horas del ocho de julio del dos mil catorce, en la cual el Banco Popular y de Desarrollo Comunal vende a [Nombre 032] Sociedad Anónima la finca del Partido de Guanacaste, matricula número [Valor 003] , de esta escritura se logra acreditar de forma certera que quien comparece en representación de la citada Sociedad es el imputado [Nombre 001] , es decir para el día 08 de julio del 2014 el encartado aún era representante legal de la mencionada Sociedad.
Aunado a lo indicado, en el debate se contó con el testimonio del señor [Nombre 027] , quien labora para el Banco Popular de esta localidad, este testigo mencionó que recuerda al encartado [Nombre 001] por ser representante de la Sociedad [Nombre 032], la cual compró un bien adjudicado por el banco, continúa indicando el testigo que el procedimiento normal de las ventas de estas propiedades, es asignar a una persona que viva y cuide estos inmuebles mientras el Banco procede a venderlos, a esta figura se le llama comodatario, el procedimiento normal es que una vez el Banco vende la propiedad, se le otorgan mínimo quince días a la persona que habita en la propiedad para que proceda a desalojar el inmueble, en el debate el testigo de forma espontánea acotó que recuerda perfectamente el caso del señor [Nombre 001] , debido a que una vez el imputado firmó la escritura de compra y constitución de hipoteca, procedió inmediatamente a desalojar al comodatario del bien inmueble que había comprado la Sociedad que para ese momento representaba [Nombre 001].
Otro aspecto de suma importancia mencionado por este testigo, es que la persona que cuidaba el inmueble le indicó que ya estaban construyendo en la propiedad, esto sin haber abandonado el comodatario, menciona el señor [Nombre 027], que él se hizo presente a la propiedad y al conversar con el encargado de la construcción esta persona inmediatamente llama a don [Nombre 001] y este le indica que él (el imputado) ya era el dueño del inmueble, que ya se había firmado la escritura por lo que él era el dueño de la propiedad. Lo indicado por este testigo viene a desacreditar por completo la tesis de la defensa técnica, ha quedado comprobado con la prueba que consta en el expediente que para el momento en que dan inicio las obras en el inmueble ya mencionado, la cuales invadieron la zona de protección el encartado era el representante legal de [Nombre 032] S.A y además, él era la persona a cargo de los obreros de construcción que realizaron la ampliación en dicho inmueble.
Aunado a lo indicado el imputado participó durante todo el desarrollo del proceso, desde el primer momento en que se realizó la paralización de las obras e incluso participó de la inspección realizada en campo para el levantamiento topográfico de la propiedad, tal y como se indicó lineas atrás. Así las cosas, el alegato de la defensa no es de recibo, por el contrario ha quedado acreditado con los testigos de cargo y el testigo [Nombre 027] aportaron contundentes elementos de convicción, que analizados de manera concatenada con la prueba documental, llevan a tener por acreditado con certeza el cuadro fáctico acusado por el Ministerio Público, querellado por la Procuraduría General de la República y detallado en los hechos de la Acción Civil Resarcitoria. Por otra parte el imputado, declaró en el juicio que todo este proceso se debe a problemas personales que tiene con su hermano [Nombre 011] quien tiene un puesto importante en la Municipalidad de Nicoya, este es el motivo según indica el imputado por el cual el señor Josue Ruíz le ha dado persecución y que hay muchas cosas que generan la persecución, que él tiene todos los permisos y todo en regla y hay cosas que no entiende.
Esta declaración del imputado al ser valorada de forma conjunta con los demás elementos probatorios del proceso no cuenta con sustento alguno. En primer lugar, no se logra establecer que exista alguna persecución personal en contra del imputado, y que la misma haya sido el motivo principal por el cual se le sigue una causa penal, por el delito de invasión a una zona de protección del río Chipanzo, por el contrario pudo constatar esta autoridad al valorar los elementos probatorios del expediente que el imputado [Nombre 001] actúo contrario a derecho y este es el motivo por el cual se inició una causa penal en su contra, hay que recordar que al presentarse la autoridad Municipal a la construcción que realizaba el imputado, se procedió a paralizar la obra y a otorgarle al encartado el plazo de treinta días para que se apersonara a la Municipalidad de Nicoya para cumplir con los requisitos legales, sin embargo, el endilgado haciendo caso omiso a estas prevenciones decidió continuar con las obras hasta finalizarlas.
Es decir, no puede alegar el imputado una persecución en su contra, cuando es él quien actuando con total conocimiento decide infringir la ley e inclusive ignora en dos oportunidades las advertencias de los supervisores de la Municipalidad de Nicoya y decide por su cuenta terminar las obras que le fueron paralizadas. Otro aspecto importante, es que el señor [Nombre 001], indica que él tenía todos los permisos de estas obras, pero en el expediente no consta tal información, no aportó la defensa prueba alguna que pueda confirmar el dicho del señor [Nombre 001] " (folios 283 a 288).
Tal y como se desprende de la amplia fundamentación intelectiva de la sentencia, en la misma se justificó adecuadamente por qué se tuvieron por demostrados los hechos acusados y querellados y la participación que como autor de lo mismos se le atribuyó al imputado [Nombre 001], quien como se señaló supra, no solo era el presidente y representante de la sociedad propietaria de la finca en la que se realizaron las obras constructivas, sino que durante las visitas de inspección realizadas por funcionarios municipales, señores José Ruiz Guerrero y Jesús Alberto Obadía Vargas, fue señalado por los trabajadores de la construcción como el contratista de las obras y en esa condición se presentó al lugar y fue notificado de las órdenes de suspensión de obra, actuaciones que fueron debidamente documentadas en el expediente administrativo de la Municipalidad de Nicoya aportado como prueba. La valoración de la prueba realizada por el a quo cumple con lo preceptuado en el numeral 184 del Código Procesal Penal en el tanto es el producto de una valoración conjunta y armónica de la prueba testimonial, documental y pericial, toda la cual aparece como plenamente coincidente entre sí, pudiendo comprobarse los aspectos esenciales de los hechos que conforman la imputación delictiva, mediante los diferentes medios de prueba, al resultar coincidentes y contestes, tal y como se resalta en la sentencia recurrida por parte de la persona juzgadora.
Por todo lo anterior, no lleva ninguna razón el recurrente al alegar que fue considerado autor de los hechos por ser apoderado de la sociedad propietaria del inmueble, tampoco es atendible el alegato de que el Juez indica que el imputado firmó actas sin indicar cuales, cuando claramente se hace referencia en la sentencia al acta de paralización de construcción de folio 1 del declaración del testigo Josué Ruiz es parte del haber probatorio a partir del cual se tuvieron por demostrados los hechos y la autoría del imputado en la invasión a zona protectora atribuida, como ya se acaba de indicar, dicha acreditación no solo depende del dicho del mencionado testigo, sino también de la declaración del señor Obaldía Vargas y de prueba documental como actas de paralización de construcciones, fotografías, informes del Sistema Nacional de Conservación del MINAE, pericia judicial y en general de la documentación incorporada al debate, de ahí que aunque hipotéticamente se admitiera que el testigo Josué Ruiz mantiene negocios con un hermano del imputado quien es su enemigo, claramente dichas diferencias, de existir, no tuvieron incidencia alguna en la acreditación de los hechos ni en la valoración como creíble del citado testigo, cuya declaración fue valorada como creíble.
Tampoco tiene relevancia alguna la formalidad de que para la fecha de los hechos el inmueble objeto de litigio continuara inscrito a nombre del Banco Popular o que en una declaración de bienes ante la Municipalidad de Nicoya el representante del Banco Popular hubiera manifestado que dicha institución era la propietaria. Tal y como se desprende de la declaración del testigo [Nombre 027], descrita a partir de folio 281 frente y se consignó en la transcripción de la fundamentación intelectiva de la sentencia, para la fecha de los hechos el imputado se encontraba poseyendo el inmueble de marras, cuya propietaria era su representada [Nombre 032] S. A. El citado testigo declaró que desde que se firmó la escritura de traspaso el imputado tomó posesión del bien inmueble y no se pudo cumplir con el procedimiento de dar aviso al comodatario encargado del mismo para la puesta en posesión sino que el encartado lo desalojó del inmueble.
Por otro lado, se demostró que el traspaso del inmueble se realizó el día 8 de julio de 2014, aunque el documento se inscribió hasta el 9 de setiembre de 2014 (cfr. folio 30), razón que explica por qué hasta ese momento estuvo formalmente inscrita la propiedad a nombre del Banco Popular, circunstancia totalmente intrascendente. Para el recurrente no existe prueba de que el imputado para la fecha de los hechos que se describe en las imputaciones delictivas hubiera invadido la zona de protección del Río Chipanzo, porque el testigo José Elías Benavides manifestó que lo que se invadía del área de protección y que no estaba construido conforme a la ley (retiro de 5 metros) era un alero que no estaba adherido al suelo y que en el informe ACT-OSRN-122-14 del 6 de agosto de 2014, de folio 45, recomendó la autorización para la construcción tras constatar que no había invasión a la zona de protección del río, ante lo cual, de haber sucedido los hechos lo fue entre el 6 de agosto de 2014 y el 30 de enero de 2015.
Dicho alegado no es atendible. Si bien debe aceptarse que para la primera quincena de julio de 2014 la totalidad de la invasión a la zona de protección del Río Chipanzo no se había concretado, pues como se extrae de la prueba testimonial, el avance de las obras era de un 20%, asimismo, se observa que las obras recién empezaban a levantarse, ello en las fotografías de folio 2 del expediente de la Municipalidad de de Nicoya, lo cierto es que desde ese momento el testigo Josué Ruiz Granados detectó que se estaba invadiendo la zona de protección del Río Chipanzo, así lo declaró en el debate y lo consignó en el acta de folio 1, pudiendo observarse en las fotografías de folio 2 citadas, el proceso de construcción de tres columnas por la parte exterior de la malla que se ubicaba en la colindancia del río, por lo que claramente para la fecha de los hechos acusados ya se estaba dando el proceso de invasión del área de protección, el cual para el 19 de setiembre de 2014 se había consolidado en su totalidad con el 100% de avance en la construcción del techo y los muros perimetrales (cfr. actas y fotografías de folios 6 al 10).
Construcción total sobre la cual se realizó la pericia por parte del Organismo de Investigación Judicial (folios 25 a 27 del expediente principal), con las conclusiones ya conocidas de la afectación del área de protección del Río Chipanzo. Ante la contundencia de tales pruebas, el informe de inspección de folio 45 del 6 de agosto de 2014 suscrito por [Nombre 023] funcionario del Sistema Nacional de Áreas de Conservación, en el que se concluyó que el río está a 10 metros del lugar donde va la construcción y que se recomienda otorgar la certificación para efectos de construcción, debe ser tomado con reserva y restarle todo valor, debiéndose rechazar dicha prueba, porque es abundante la prueba documental y también testimonial que acredita la invasión de la zona de protección desde los inicios de la construcción, invasión que el mismo funcionario luego determina su existencia (informe de folio 46), en los mismos términos que lo determinó el Organismo de Investigación Judicial, declarando también en el debate que en la visita que concluyó con el informe de folio 45, realizada el 6 de agosto de 2014, también comprobó la invasión a la zona de protección del Río Chipanzo, desvirtuando la información consignada en el informe de folio 45 relacionada con la ausencia de afectación de la zona de protección del Río Chipanzo.
Por lo anterior, no lleva razón el recurrente al sostener que la invasión sucedió con posterioridad al 6 de agosto de 2014, sino desde la primera quincena de julio de 2014, lo cual fue correctamente determinado en sentencia, proceso de invasión que para el 9 de setiembre de 2014 ya se había consolidado tal y como se acaba de señalar. Finalmente la no consideración del expediente crediticio en función de establecer la existencia de edificaciones preexistentes al momento de la adquisición del inmueble por [Nombre 032] S. A., no constituye vicio alguno a la luz de lo expuesto supra, en el tanto tales construcciones fueron demolidas por el imputado para realizar la nueva construcción, resultando en todo caso, que la una y la otra debían respetar como zona de protección un retiro de 10 metros de la orilla del Río Chipanzo, y el hecho de que la construcción preexistente estuviera invadiendo la zona protectora tampoco le otorgaba a la sociedad titular del inmueble derecho alguno para perpetuar dicha invasión y menos mediante la construcción de obras que sustituyeron las construcciones existentes, aunque se hubieran realizado en el mismo lugar de las anteriores.
Tanto el Ministerio Público, representado por el licenciado Luis Diego Quesada Canales, como la licenciada Zaray Chavarría en representación de la Procuraduría General de la República, solicitaron que el recurso de apelación por adhesión fuera declarado inadmisible por falta de agravio causado por la sentencia a la institución acreedora. Para esta Cámara de Apelación el recurso de apelación interpuesto por el representante del Banco Popular es admisible. Se alega por el recurrente que al Banco Popular se le causa un gravamen con la orden del restablecimiento de las cosas a su estado original en los términos que fue ordenado en la sentencia, dado que ello implica una depreciación de la garantía hipotecaria que tiene el Banco Popular en relación con el crédito otorgado a la sociedad [Nombre 032] S. A., titular del inmueble. Desde esa perspectiva y en abstracto, es viable considerar la posibilidad de un perjuicio para el recurrente adhesivo si la demolición de lo construido en los términos que se ordenó es improcedente, tema que se resolverá al pronunciarnos sobre el fondo del recurso de apelación.
Por el fondo se rechaza el cuarto motivo del recurso de apelación interpuesto por la Defensa Técnica y el recurso de apelación por adhesión interpuesto por el representante del Banco Popular. En ambos casos se alega la improcedencia del regreso de las cosas al estado original. Alegó el licenciado Porras Leiva que según el informe de folio 60 donde se valoró el daño ambiental, el inmueble existía al momento de los hechos acusados que establecía una área de protección de cinco metros de la margen del río, por lo que fue hecha a Derecho y no procedía su destrucción, por lo que la demolición solo procedía respecto de lo construido para la fecha de los hechos, pero que tampoco procede, porque según el informe de folio 45 del expediente administrativo de la Municipalidad de Nicoya, no existía invasión al área de protección del Río Chipanzo, pues estaba a 10 metros de la construcción. Sostiene que lo que estaba previamente construido no debe demolerse pues contaba con los permisos respectivos como se desprende de la prueba aportada de folios 245 a 248 del principal.
Concluyó diciendo que la [Nombre 032] de Nicoya es la única engañada pues compró una propiedad desconociendo los vicios ocultos que tenía respecto de las restricciones por el área de protección. A lo anterior el licenciado Víctor Hugo Castro Cartín le agregó que no se ha presentado prueba que acredite cuál es el porcentaje de obras que se encuentran actualmente edificadas como construcción nueva que es respecto de lo que procede la demolición.
Se afirma nuevamente que la Ley Forestal anterior a la que se encuentra actualmente en vigencia, y que estuvo vigente hasta el 16 de abril de 1996, establecía una zona de protección de cinco metros a ambos lados en las riberas de los ríos en terrenos planos, y que ello consta en la valoración del daño ambiental de folio 60. Lo anterior ya fue analizado por esta Cámara en los acápites precedentes, determinándose que si bien la zona de protección en relación con ríos en terrenos planos era inicialmente de 5 metros (artículo 84), ello cambió a partir del 16 de julio de 1990 que entró en vigencia la Ley número 7174 que reformó la Ley Forestal 4465, fijando una zona de protección en relación a ríos de 10 metros en terreno plano (artículo 68). Dicha zona de protección se ha mantenido hasta la fecha, por ya casi 31 años, puesto que la Ley Forestal actual vigente desde el 16 de abril de 1996 (número 7575), contempla la misma zona de protección de 10 metros para el caso de terrenos en zona urbana y en terrenos planos que es el supuesto de marras.
También ya se analizó que no se demostró como hecho cierto, que la edificación existente al momento que la [Nombre 032] S. A. adquirió el inmueble en cuestión, hubiera sido construida antes de la citada reforma de la Ley Forestal 4465 vigente a partir del 16 de julio de 1990, lo que como se dijo resulta intrascendente desde que la mencionada construcción fue demolida y en su lugar se levantó la actual. Se insiste en afirmar en los reclamos que la restitución de las cosas al estado original solamente conllevaría la demolición de lo construido para la fecha de los hechos y no de la construcción preexistente. En el acápite anterior (C), se analizó y resolvió en cuanto a que con la prueba aportada en el expediente administrativo de la Municipalidad de Nicoya, la construcción preexistente fue demolida por los trabajadores contratados por el imputado y dejó de existir, siendo sustituida por una nueva construcción, la que para poder realizarse no solo debía contar con los respectivos permisos municipales, requisito que no se cumplió, sino que además debía respetar el área de protección del Río Chipanzo consistente en una franja de diez metros de la rivera del río por tratarse de un terreno plano ubicado en zona urbana (art. 33 de la Ley Forestal), sin que la ubicación de la construcción anterior que dejó de existir otorgara derecho alguno a la propietaria del inmueble si se ubicaba en zona de protección, como se infiere del recurso por adhesión, por haber sido realizada dicha construcción contraviniendo la Ley Forestal, ya sea la derogada Ley 4465 o la actual Ley 7575, de manera que, si la construcción anterior existiera y se hubiera comprobado que invadía la zona de protección del Río Chipanzo, como en efecto sucedía con la malla, igual procedía la demolición hasta liberar en su totalidad la zona de protección, aunque las obras se hubieran realizado con autorización de la Municipalidad y aunque por ello no pudiera exigirse responsabilidad penal y civil al imputado o responsabilidad civil a la sociedad propietaria.
Lo anterior es lo que explica que la valoración del daño ambiental solamente se haya realizado respecto de la porción de la construcción que amplió el área invadida a partir de la edificación que existía previamente, valoración que no ha sido cuestionada en modo alguno. Pero la valoración del daño es solo eso, la determinación en términos monetarios del perjuicio causado por el que se puede responsabilizar a los demandados civiles, y no la determinación del área invadida y de la zona de protección que debe ser liberada, ello se estableció a partir de mediciones realizadas por funcionarios de Sistema de Conservación Áreas de Protección del MINAE, pero particularmente por el Organismo de Investigación Judicial, tal y como quedó ampliamente analizado en el acápite anterior (C). También en el acápite anterior se determinó que el informe de folio 45 carece de valor probatorio, en el contexto de la valoración conjunta de prueba, y porque el mismo funcionario que lo suscribió, el testigo José Elías Benavides en su declaración rendida en debate afirmó que en esa oportunidad había constatado la invasión a la zona de protección, por lo que el contenido de ese documento no se ajusta a la realidad de lo acontecido.
En una situación como la presente tampoco es atendible el alegato de que [Nombre 032] S.A., fue engañada pues compró una propiedad que presentaba vicios ocultos. No se ha demostrado en este proceso que el Río Chipanzo no era visible a simple vista, por el contrario, incluso aparece descrito en la colindancia de la misma y no es posible admitir que se alegue ignorancia de disposiciones legales con una vigencia de más de treinta años, sobre lo cual, cualquier duda pudo ser evacuada oportunamente por los profesionales en Derecho que autorizaron la escritura de traspaso. El anterior razonamiento es igualmente aplicable para el codemandado civil Banco Popular, quien fue propietario del inmueble de marras y la valoración del mismo así como la aceptación de una garantía hipotecaria debía considerar el respeto de la zona de protección. Por otro lado, es evidente que en este caso el préstamo de dinero no se autorizó para la demolición de la estructura existente y la construcción de la bodega, el parqueo y la acera, sino para remodelación de la estructura existente, tal y como lo declaró el testigo [Nombre 027], resultando más que obvio que no hubo una adecuada supervisión de la aplicación del crédito por el Banco acreedor y por ello igualmente debe correr con los perjuicios que le implique el desmejoramiento de la garantía por la restitución de las cosas al estado original, que implica la demolición de lo construido hasta liberar totalmente la zona de protección del Río Chipanzo, que es exactamente lo dispuesto en la sentencia según lo determinado pericialmente (cfr. parte dispositiva, folios 301 vlto a 302 fte).
Se alega en el motivo inexistencia de vínculo jurídico por la inexistencia de daño ambiental para el mes de junio de 2015. Se argumenta que la sentencia tuvo por demostrados hechos que no se derivan de la prueba, que a su vez sirvieron de base a la condena civil y que el juez no valoró el peritaje de folio 61 donde se estableció que en la zona de protección del Río Chipanzo no existía afectación alguna en los límites de la finca [Valor 003] por lo que no había daño ambiental alguno. El reclamo no es procedente. En primer lugar, se parte de una afirmación totalmente desvirtuada como lo es que los hechos demostrados no se derivan de la prueba, lo cual ya ha sido ampliamente analizado a lo largo de esta resolución, determinándose que la sentencia impugnada realizó una correcta determinación de los hechos. En segundo lugar, el documento de folio 61 del expediente administrativo de la Municipalidad de Nicoya en el que el recurrente basa su alegado de inexistencia de daño ambiental, solo hace referencia a que en el área de protección del Río Chipanzo no hubo afectación de los siguientes tipos: tala de árboles, movimientos de tierra, desvío de aguas, contaminación con aguas negras o jabonozas, lo que no excluye que se haya dado afectación del área de protección por invasión de la zona de protección del Río Chipanzo en los términos que se tuvo por demostrado en la sentencia, esto es, a partir de la primera quincena del mes de julio de 2014, y en la modalidad de afectación no excluida por el documento de folio 61 citado, esto mes por medio de invasión.
La afectación al Medioambiente que produjo dicha invasión, es precisamente lo valorado como daño ambiental, para lo cual solamente se consideró de la invasión total acreditada, una área de 44 metros cuadrados, según se desprende del documento de folios 59 a 60 del principal, lo que no fue cuestionado en modo alguno y se el perito correspondía a la ampliación del área invadida para la fecha de los hechos en relación al área que ya se encontraba invadida de previo a que la sociedad propietaria adquiriera el bien (patio sin cobertura con malla tipo ciclón) y que realizara la demolición de la construcción preexistente y se realizara una nueva.
Asimismo, se autorizan obras de bajo impacto ambiental tales como plataformas de observación, puentes, puentes colgantes, tirolesas, elementos de señalización y Otros elementos que permita el acceso, la observación y el disfrute seguro de las áreas naturales con el menor impacto posible, cuando tengan como fin el desarrollo de actividades turísticas, entre otras". Nada de lo anterior forma parte de los alegatos expuestos por el recurrente y mucho menos se demostró que la construcción realizada tuviera alguno de los fines citados y tampoco que hubiera contado con la autorización respectiva.
VII.En la sentencia recurrida se dispuso la restitución de las cosas a su estado anterior, mediante el derribo de las estructuras y construcciones ubicadas dentro del área de protección de la finca inscrita en el Partido de Guanacaste, matricula número [Valor 003], ubicada en la [...] , propiedad de [Nombre 032] de Nicoya Sociedad Anónima, según lo indicado en la Ampliación de Dictamen Pericial DCF:2018-00896-ING, elaborado por el Departamento de Ciencias Forenses, Sección de Ingeniería Forense, Organismo de Investigación Judicial, esto por estar invadiendo una zona de protección. Para el cumplimiento de lo anterior se otorgó al imputado y demandado civil [Nombre 001] un plazo de dos meses a partir de la firmeza de la sentencia para que proceda con el derribo de las estructuras construídas dentro del área de protección del Río Chimpanzo, corriendo a su cuenta los gastos por concepto de derribo y retiro de materiales del lugar afectado.
Se ordena al Ministerio de Ambiente, Energía y Telecomunicaciones, Sistema Nacional de Áreas de Conservación, Área de Conservación Tempisque, realizar la inspección y rendir el Informe a fin de constatar el cumplimento de lo ordenado en la presente sentencia. Se previene a [Nombre 001] , del carácter obligatorio de lo que se resuelve, pudiéndosele seguir causa por el Delito de Desobediencia a la autoridad en caso de incumplimiento. Es criterio de esta Cámara que dicho extremo de la sentencia debe ser ampliado oficiosamente, tanto en la parte considerativa como en la dispositiva para que se incluya como responsable de la demolición dispuesta también a la codemandada civil [Nombre 032] S. A. quien es la titular del inmueble en el que se encuentran las obras que deben ser demolidas, de ahi que la misma prevención que se hizo al encartado se le debe hacer a la representante legal de la citada sociedad, la señora [Nombre 037].
La restitución de las cosas a su estado original es una consecuencia civil de delito (art. 103 inciso 1 del Código Penal) y las personas jurídicas responden civilmente y de forma solidaria con sus gerentes y administradores que resulten responsables de los hechos punibles (art. 106 inciso 2 del Código Penal y 57 de la Ley Forestal).
POR TANTO:
Con fundamento en lo expuesto se declara sin lugar el recurso de apelación interpuesto por el licenciado Jorge Enrique Porras Leiva en condición de Defensor del imputado [Nombre 001] y como apoderado especial judicial de la codemandada civil [Nombre 032] S. A. y el recurso de apelación por adhesión interpuesto por el licenciado Víctor Hugo Castro Cartín, en representación del Banco Popular y de Desarrollo Comunal.De oficio se modifica y amplía el acápite VI de la parte dispositiva de la sentencia impugnada quedando en los siguientes términos: VI.- Sobre la restitución de las cosas a su estado anterior: Una vez firme la sentencia y de conformidad con el artículo 140 del Código Procesal Penal, 103 del Código Penal, y 33, 34 y 58 incisos a) y b) de la Ley Forestal, se ordena la restitución de la cosas a su estado original de la zona de protección afectada; asimismo, se ordena el derribo de las estructuras y construcciones ubicadas dentro del área de protección de la finca inscrita en el Partido de Guanacaste, matricula número [Valor 003], ubicada en la [...], propiedad de [Nombre 032] de Nicoya Sociedad Anónima, según lo indicado en la Ampliación de Dictamen Pericial DCF:2018-00896-ING, elaborado por el Departamento de Ciencias Forenses, Sección de Ingeniería Forense, Organismo de Investigación Judicial, esto por estar invadiendo una zona de protección.
Se otorga el plazo de dos meses después de la firmeza de la sentencia, para que [Nombre 001] y la codemandada civil [Nombre 032] S. A. representada por su presidenta con facultades de apoderada generlísima sin limite de suma la señora [Nombre 037], procedan con el derribo de las estructuras construídas dentro del área de protección del Río Chimpanzo, corriendo por su cuenta los gastos por concepto de derribo y retiro de materiales del lugar afectado. Se ordena al Ministerio de Ambiente, Energía y Telecomunicaciones, Sistema Nacional de Áreas de Conservación, Área de Conservación Tempisque, realizar la inspección y rendir el Informe a fin de constatar el cumplimento de lo ordenado en la presente sentencia. Se previene a [Nombre 001] y a la señora [Nombre 037], del carácter obligatorio de lo que se resuelve, pudiéndoseles seguir causa por el Delito de Desobediencia a la autoridad en caso de incumplimiento.
Comuníquese lo aquí resuelto a la Municipalidad de Nicoya, Guanacaste. Notíquese.- Jorge A. Camacho Morales Gustavo A.
