WHEREAS:

I - Claims: The plaintiff requests that the judgment declare the following: 1.- That the present ordinary adverse-possession action (usucapión) be granted in all respects. 2.- That the negative prescription (prescripción negativa) of any restitution rights that the defendant herein, [Nombre3] , may have be ordered. 3.- That the existence of the requirements for acquisitive prescription (prescripción positiva) in favor of [[Nombre1] ], [...], be declared with respect to the property located in the First District, Canton of Nicoya, Province of Guanacaste. II.Defenses raised: The defendant was duly served but did not answer the complaint; he was therefore declared in default (rebelde) by an order issued at ten hours and twenty-three minutes on veintinueve de noviembre del año dos mil diecinueve, (See case file downloaded in PDF format, images 112 through 113, and proof of service in image 107).-

III.By Judgment No. 266-2022, issued at sixteen hours and twenty-seven minutes on cinco de octubre de dos mil veintidós, Judge Wálter Ávila Quirós ruled: “In accordance with the cited facts and law, the complaint filed by the ESTATE OF [[Nombre1] ], represented by its executor [[Nombre2] ], against [Nombre3] , is DENIED in all respects. This matter is resolved without a special award of costs,” (See case file downloaded in PDF format, images 240 through 247).-

IV. The list of facts deemed proven is adopted because it is consistent with the body of evidence (acervo probatorio).-

V. The set of facts deemed unproven is affirmed because it lacks supporting evidence.-

VI.The plaintiff appeals the judgment rendered, according to the brief added to the filing inbox and submitted on 10/10/2022 at 6:34:01 a.m., stating as follows: GROUNDS FOR APPEAL: “FIRST: Pursuant to Article 41, which states that all persons shall be equal in seeking recourse under the law, in conjunction with Article 27, which guarantees freedom of petition and the right to obtain a prompt resolution, both articles of the Political Constitution of Costa Rica, it is distressingly asserted that these proceedings, and even more so the judgment under appeal, have fallen into preterintent (preterintención), understood as follows: ‘A preterintentional act is one that produces consequences less serious than those intended. Preterintent is used as a synonym for preterintentionality. Both concepts derive from the Latin expression praeter intentionem, which refers to acting “beyond the intention.”’ And why is this stated?

Because it should be noted that this case file dates from 2019, and through the judgment now under appeal, the plaintiff has been litigating these proceedings without an opposing party, since the defendant was duly served but, to this day, has NEVER entered an appearance; and although it was repeatedly requested that he be declared in default (rebeldía), no such declaration was ever issued in these proceedings. It might therefore have been expected that these proceedings would move quickly because there was no opposition, but my client has had to struggle alone to enforce her rights and obtain due process. Consider that an act that should not involve any dispute—serving notice on MINAET, the Office of the Attorney General, and INDER—is an act required by law in every agrarian proceeding; yet in the case at issue, despite the request, instead of carrying out that act, an order of dismissal for inactivity (caducidad) was entered against my client, and it therefore became necessary to file the corresponding appeal dated 01 February 2022, submitted at 14:33:01 hours.

It was decided by means of the ruling issued at 10:21 hours on 15 March 2022. Notice had already been requested for some time to all institutions whose participation is required by law, and time had to be wasted awaiting a ruling on an appeal that should never have needed to be filed, but nevertheless had to be filed. It should also be noted that the plaintiff had to change legal counsel because the lead attorney who commenced these proceedings died. Accordingly, this counsel requested, as evidence to assist the court in reaching its decision (prueba para mejor proveer), the testimony of [[Nombre4] ], because through his testimony he would truthfully recount how his grandfather was dispossessed of the disputed property by the defendant; he would identify the possessory acts (actos posesorios) carried out in recent years; explain how, as the youngest child of the deceased plaintiff, he was born on that property; and provide other clarifications that only a person close to the plaintiff could provide.

That request was denied because the Judge A Quo stated that testimonial evidence (prueba testimonial) served that purpose, and the judgment under appeal made no mention whatsoever of the documentary evidence (prueba documental) submitted. The plaintiff was harmed by this judgment because the documentary evidence submitted was neither assessed nor even mentioned. For the foregoing reasons, it is asserted that the judgment under appeal has caused even greater harm, since it finds that my client failed to defend and prove that the property in question belongs to the deceased, even though during his lifetime, when don [[Nombre1] ] was a 14-year-old boy in a different era, he came to this location to work and start his family; subsequently, when the property had to be registered, it was registered in his father’s name because he was a minor (both witnesses stated that it was the deceased and the family he formed who came to occupy that location).

SECOND: Article 40 of the Agrarian Jurisdiction Law establishes the manner in which the complaint must be served, including a warning to the defendant that any allegation he fails to answer will be deemed TRUE. However, when that article is read in conjunction with Article 43 of the same law, the latter establishes when a defendant must be declared in default, either sua sponte (de oficio) or at a party’s request. As stated in the closing arguments, that position is reiterated as follows: By the ruling issued at 15:09 hours on 6 May 2019, the present complaint was admitted for processing, and that ruling warned the defendant of the consequences of FAILING to answer and that he would be declared in DEFAULT. The defendant was served with the complaint on 10 October 2019 at 11:30 hours, and to this day Mr. [Nombre3] has taken no procedural action whatsoever and has not even designated a place for service of notices.

Since 8 November 2019, the plaintiff’s legal counsel has requested on several occasions that the defendant be declared in default. It was not until this judgment under appeal that the A Quo merely stated that the defendant was in default. In connection with the foregoing, Article 43 of the Agrarian Jurisdiction Law must be considered insofar as it provides: ‘Article 43.- If, upon expiration of the period for entering an appearance (emplazamiento), the respondent fails to answer the complaint, the judge, sua sponte or at a party’s request, shall proceed without further formality to declare the respondent in default, and the defaulting party (contumaz) shall take up the case in the posture in which it stands when that party enters an appearance……...’ This article must be read in conjunction with Article 32 of the same legislation. According to the relevant legal doctrine regarding DEFAULT, it is understood as follows: ‘Default is a factual situation: the defendant did not appear.

It is sufficient to establish that, upon expiration of the period for answering, the defendant has not entered an appearance in the proceedings for the judge to declare the defendant in default.’ It must therefore be understood that default ultimately creates a rebuttable presumption (presunción simple) against the defendant. What does this mean? As a matter of legal logic, although the law provides that the allegations will not be deemed admitted by a defaulting defendant, when the defendant fails to answer the complaint, it is in the answer that the defendant can ordinarily dispute the facts alleged by the plaintiff by pleading new facts or offering evidence. Thus, when the defendant is declared in default, it is because he neither answered the complaint nor offered any evidence. Therefore, in the case at issue, the complete absence of even a single act by the defendant during the ordinary course of these proceedings places the Judge in a difficult position, because the defendant did not rebut or dispute the allegations in the complaint at the appropriate procedural stage, which was when the complaint was served on him.

It should be noted that, in this case, the defendant did NOT participate at any stage of the proceedings and thereby entirely eliminated the adversarial process (contradictorio), leaving the allegations in the initial complaint as the only statement of facts. Accordingly, the request is reiterated that the six factual allegations set forth when the complaint was filed be deemed true, undisputed, proven, and unrebutted, because the defendant himself must bear responsibility for FAILING TO ACT or exercise his right of defense; by adopting a position of default and failing to dispute any allegation, he became subject to the rebuttable presumption that those allegations are true. Therefore, for the reasons stated herein, it is requested that all the allegations in this complaint be deemed true. Regarding default in agrarian proceedings, the case law established in Judgment 00337 of the Agrarian Court dated 29 May 1998, in case file 98-000337-0029 AG, must be analyzed.

THIRD: The judgment under appeal states that my client improperly seeks to take ownership of the portion corresponding to the Maritime-Terrestrial Zone (Zona Marítima Terrestre), whereas the complaint and the proceedings clearly establish that my clients are interested only in recovering Property Registered under Real Property Folio Number FIVE-TWENTY-THREE THOUSAND FOUR HUNDRED THIRTY-FIVE-ZERO ZERO ZERO, consisting of agricultural land located in the First District, Nicoya, Second Canton, Nicoya, Province of Guanacaste, with the following boundaries: North: [Dirección6] , South: [Dirección7] , East: [Dirección8], West: [Dirección9] , measuring sixty thousand seven hundred forty-four square meters and seventy-seven square decimeters, all pursuant to survey plan G-8925-1969. It is unclear why Judge [Nombre5] and the Office of the Attorney General stated that the plaintiff estate seeks to appropriate the Maritime-Terrestrial Zone when no act in these proceedings indicates any intent to take ownership thereof.

The plaintiff is interested only in recovering the property described above; please review this case file to verify that fact. It is emphasized that this property is not located within any forest reserve or national park and, to date, has not been subject to expropriation by the State. FOURTH: The judgment under appeal completely omitted the documentary evidence submitted, without even stating whether it was admitted. There is a fact established by documentary evidence showing that the defendant fraudulently acquired the property at issue, and because that fact was extensively proven by documentary evidence, it was requested that certified copies of the relevant portions of the record (testimoniara piezas) be transmitted to the Public Prosecutor’s Office so that the existence of fraudulent intent (dolo) could be determined. By failing to address that documentary evidence, the judgment under appeal violates Article 19 of the Political Constitution of Costa Rica, which establishes that every foreign national must fulfill the same obligations as any Costa Rican national, except with respect to the exercise of political rights.

I again set forth that documentary evidence with abundant clarity: As stated in the first factual allegation of this case, the transfer through which the defaulting defendant in this matter was awarded Property 5-23435-000 was executed by means of a deed containing defects rendering it absolutely null and void (vicios de nulidad absoluta), which constitute the criminal offense of fraud. Upon analyzing the substance of that transfer in light of the evidence submitted by the plaintiff, it can be conclusively established that Mr. [[Nombre6] ], the deceased father of the decedent who is the plaintiff herein and who had custody of that property because Mr. [[Nombre1] ] was a minor when the property was registered, was in the final days of his life and in a deplorable state of health, to such an extent that he suffered from senile dementia and other illnesses diagnosed and observed by physicians of the Caja Costarricense del Seguro Social.

It is also important to state that, according to the certification issued by the Registro Civil, all signatures registered with that institution by Mr. [[Nombre6] ] were submitted in this case so that they could be compared with the purported signature that Mr. [[Nombre6] ] allegedly affixed to transfer that property to the defaulting defendant herein. It should be noted that, given his grave state of health, although Mr. [[Nombre6] ] knew that he was not the true owner of that property, he was unable to execute a lawful instrument effectively transferring the property to its true owner, namely the decedent [[Nombre1] ], his son. It is therefore illogical to believe that, instead of transferring the property to his son, he would transfer it to an unrelated third party with whom he had no contractual relationship for the transfer of that property, particularly because Mr. [[Nombre6] ] lacked the cognitive capacity to enter into any contractual act with absolutely anyone.

And my client is correct, supported by the constitutional provisions under which, when persons consider themselves aggrieved in their rights, the Constitution itself empowers them to resort to the courts to enforce those rights; and in every proceeding there is a right of defense (derecho de defensa), a vital part of which is the evidence (prueba) offered by a person in the complaint. Here, the following evidence appearing in the record was timely offered to prove this fact as true and, moreover, it must be noted that it is uncontested: - Deed number 80 executed on 26 de febrero de 1999 - Discharge summary issued by the Caja Costarricense del Seguro Social concerning the deplorable state of health of Mr. [[Nombre6] ], demonstrating that he lacked the cognitive or mental capacity to execute the transfer to the defaulting defendant (demandado rebelde) herein, and therefore this transfer is absolutely null and void. - Copies of deeds 79, 80 and 81 of Lic. Luis Guillermo Espinoza Picón. - Certification of the copies of the file containing the identity-card applications of Mr. [[Nombre6] ] QDDG, issued by the Registro Civil de Costa Rica.

It is therefore requested that this evidence be deemed true and uncontested and that it be found to establish that the transfer deed that gave rise to the defaulting defendant’s title to the property is absolutely invalid. Accordingly, the relevant records should be certified and forwarded to the Fiscalía de fraudes. FIFTH: It is clarified that the witnesses stated that it was Mr. [[Nombre1] ] who entered into possession of the property in the 60s or earlier, because that was how things were done at the time: anyone who needed land took it. Both witnesses stated that Mr. [Nombre7] had his house and well there, married there, and had his children there. Witness [Nombre8] then stated that the last thing he saw them do was clear the firebreaks (rondas), while witness [Nombre9] said that he would not know whether they had done anything at the site recently because, due to his age, he no longer goes there, as his house is far away.

It must also be emphasized that both witnesses stated that the defendant was never seen on the property and that they imagine he is one of the many foreigners who arrived in the locality of Playa Guiones. The foregoing is corroborated by the documentary evidence submitted, and it is reiterated that the judgment under appeal made not even the slightest reference to it. The plaintiff’s predecessor in interest stated that he had possessed for more than 40 years the property recorded under Real Property Folio Number 5-23435-000 and registered under survey plan G-8925-1969. The following facts, corresponding to the plaintiff’s rights in these proceedings, must therefore be analyzed one by one: A- The survey plan that gave rise to the registration of this property dates from 1969, when the ITCO, the institution now known as INDER, administered these lands. At that time, the institution found no circumstance preventing the property from being granted to a natural person who, when it was registered, was the person exercising possession (posesión) over it.

It must therefore be concluded that, for this state institution, the property was not located within any protected area and that, to this day, no government institution has determined that this property lies within a protected area or forest reserve. This assertion is also supported by the Agrarian Judge’s inspection report: that inspection contains no finding that the property is within Parque Nacional Ostional. Furthermore, an analysis of that park’s boundaries and boundary markers shows that the property is outside that wildlife conservation park established for the protection of turtles. This is also supported by the testimony, in which the Judge asked the witnesses about the matter and they stated that turtles did not come there, but rather to Playa Ostional. B- The property to be acquired by adverse possession (usucapión) in favor of the plaintiff was extensively analyzed in VOTO N°164- C-20 of the Tribunal Agrario del Segundo Circuito Judicial de San José.

That decision determined that the property entered the legal land-registration system in accordance with law through the actions then taken by the State through the relevant institutions, and therefore these proceedings “…. CONSTITUTE AN ACTION IN REM FOR A DECLARATION OF OWNERSHIP OVER REGISTERED REAL PROPERTY…” The foregoing must now be analyzed as a whole in accordance with the discussion in the book Jurisprudencia de Derecho Agrario y Ambiental by Prof. Enrique Ulate Chacón, a specialist in Agrarian Law, page 274, Judgment number 171 of the Sala Primera de la Corte Suprema de Justicia, which addresses the Publician action asserting a superior right of possession (Acción publiciana de mejor derecho de posesión) and the nullity of the sale of property belonging to another, in conjunction with the provisions on page 291 of the same book, Judgment N|3 of the Sala Primera de la Corte Suprema de Justicia, Superior Right, Restitution, Admissibility, Agrarian Possession Based on Kinship.

Everything stated thus far under this point must be analyzed in light of the facts: the plaintiff exercised possessory rights over this property before the property even entered the Land Registry system. Because the plaintiff’s predecessor in interest was not of legal age, he had to rely on his father to register the property. As has already been demonstrated, the defaulting defendant’s transfer of the property—which in reality belonged to someone other than the registered owner—is absolutely null and void; due to the transferor’s state of health when the deed was executed, he was unable to say so. The reality, however, is that Mr. [[Nombre1] ] possessed this property, had his house here, his children were born here, and they cultivated this land. Because of don [[Nombre1] ]’s state of health, his children continued exercising possession through acts such as repairing fences and attempting to clear the property.

The young man [[Nombre4] ] carries out fishing activities on the property because, after fishing, he uses the property to clean his catch. It must therefore be declared that the person entitled to the superior right of possession and who participated in the proceedings before the Registro Nacional de la Propiedad for the registration of this registered property is Mr. [[Nombre1] ] and, consequently, today, his estate. In conclusion, the testimonial evidence more than sufficiently demonstrates that the defaulting defendant never possessed this property and that, from the time it was unappropriated public land (baldía), it was possessed by don [Nombre7]. Accordingly, acquisitive prescription (usucapión positiva) must be decreed in favor of the Estate of the late don [[Nombre1] ]. These proceedings are being heard in the agrarian jurisdiction because of their subject matter, as this is land designated by the Costa Rican State for agricultural purposes ever since it entered the Land Registry system.

Had the defaulting defendant not carried out an absolutely null and void transfer to unlawfully appropriate this property, the plaintiff herein could have used any other legal procedure available to him to register it, since, for don [Nombre7], it was his father—that is, his progenitor—who held the property in his name in the Registry, and he would not have had to proceed as he has in these proceedings against a third party acting in bad faith who never possessed the property. On the contrary, the plaintiff estate has possessed this property since don [Nombre7] was alive. SIXTH: It is stated that, to succeed in an action for recovery of ownership (acción reivindicatoria), it is not enough to be the owner according to the Registro Público de la Propiedad, since that merely constitutes record title (titularidad). Being the owner means having exercised the attributes of ownership (atributos del dominio) over the claimed property and, in particular, having been its possessor, by demonstrating effective and stable possessory acts establishing actual ownership, whether personally or through prior transferors.

Being the owner does not mean merely being so according to a document, but also having performed acts of exercise and enjoyment. As regards the exercise of ownership through acts of disposition and, specifically, through possession, those acts must be sufficient to demonstrate that judicial protection is afforded to the person who, at a given time, fully held all the attributes of ownership.” (Resolution No. 241 of 16 hours 25 minutes on 17 de julio de 1990, emphasis added). The foregoing appears in Opinión Jurídica OJ-050-2006. It must therefore be understood that the defendant performed no act to recover the property in question for his own benefit because he knows that his acquisition title was not lawfully obtained, that the instrument transferring title (título traslativo) is absolutely null and void due to the transferor’s lack of consent, since the latter lacked the mental capacity to perform that act.

The defendant also knew that he could not prove possession. It should be noted that, upon acquiring the property, he undertook a series of acts to increase its size unlawfully, and therefore the property now bears a notice of administrative warning (anotación de advertencia administrativa) registered under reference EXP. ADM 2011-00338-RIM. The defendant has sought only to harm the plaintiff herein and the State of Costa Rica, and his bad-faith conduct should therefore not be rewarded. This Authority is hereby called upon to uphold justice for my client; please do not allow foreigners to believe that they can come to our country and act in this manner. The predecessor in interest saw no reason to believe that his property was at risk. As a humble farmer, he considered the fact that his property was registered in his father’s name more than sufficient to prevent its loss, and therein lay his good faith.

The predecessor in interest earned title by entering into possession of the property at only 14 years of age; he cultivated it with his family. Although he later moved farther inland in Nosara so that his children would be closer to a school, title to the property already existed in his father’s name, and to him that title was his own. If one visits Playa Guiones, one will see that it has been taken over by foreigners and that few natives remain; however, those who do remain know that this property belongs to don [[Nombre1] ] and his children, and it is the community of Playa Guiones that wonders why the property is not held by its true owners. Accordingly, it has been demonstrated through both testimonial and documentary evidence that, when the property was unappropriated public land in the 50s and 60s, don [[Nombre1] ] entered the brush, cleared and worked the property, established his family there, and his children were born there, all publicly, peacefully, and under a claim of ownership (a título de dueño).

Therefore, when the ITCO registered it at that time, don [[Nombre1] ], having met all the requirements despite having been a minor when those formalities began, was allowed to register it through his legal representative, his father. The property remained registered in that manner until the defaulting defendant, maliciously and fraudulently, obtained absolutely null and void title to it. There is therefore no alternative but to restore the property to its true owners, the present heirs of don [[Nombre1] ], who, after all, were born on this property, helped their father with the crops, and, toward the end, helped clear the firebreaks." (See case file downloaded in pdf format, images 252 to 262).-

VII.Regarding his grounds for appeal, the appellant is incorrect. First, in agrarian matters, unlike civil proceedings, the defendant’s default (rebeldía) does not mean that the allegations in the complaint are deemed true or that the complaint must necessarily be granted, because special agrarian legislation applies, such as Article 41 of the Ley de Jurisdicción Agraria, which provides that failure to answer the complaint shall not imply that the allegations are accepted. Second, annulment (nulidad) of the transfer made by the plaintiff’s father to the defendant in the year 1999 is not appropriate, because it was not requested in the complaint, and the plaintiff cannot, at this stage of the proceedings and through an appeal, attempt to expand the complaint with respect to the relief sought (Article 35.6 of the Código Procesal Civil, applied supplementarily). As to the remaining grounds for appeal, the claim for acquisitive prescription (usucapión) was dismissed primarily because the plaintiff does not exercise possession (posesión) in good faith (buena fe), pursuant to Articles 853, 285 and 286 of the Código Civil, since he has always been fully aware that the property in dispute (finca en litis) was registered in the Registro Público in his father’s name and, after the year 1999, in the defendant’s name; therefore, his possession is not sufficient to acquire ownership by prescription.

This Tribunal has repeatedly held: “Regarding the doctrine of AGRARIAN ACQUISITIVE PRESCRIPTION (USUCAPION AGRARIA), it is necessary to distinguish special agrarian acquisitive prescription—governed by the Ley de Tierras y Colonización—from ordinary agrarian acquisitive prescription. Special agrarian acquisitive prescription dispenses with just title (justo título) and good faith, as the Ley de Tierras itself so provides in Articles 92 and 101, but it requires public, peaceful, uninterrupted agrarian possession (posesión agraria) for more than ten years over land registered in the name of a third party, provided that the possessory acts (actos posesorios) and agrarian activity are carried out to meet the possessor’s own or family needs. Ordinary agrarian acquisitive prescription, by contrast, requires just title and good faith in addition to the foregoing requirements. It may arise from an original cause (such as the right of possession (derecho de posesión)) or a derivative cause (through a contract transferring possession (contrato traslativo posesorio)).

With respect to good or bad faith (mala fe), the former is always presumed; however, a possessor acts in bad faith if, upon taking possession, the possessor had sufficient grounds for doubt (Articles 284, 287 and 286 of the Código Civil). Good or bad faith is linked to the person’s belief that the person is possessing property belonging to that person and that the person who transferred it was its lawful owner.” Tribunal Agrario, Voto No. 1033-F-06 de las once horas veinticinco minutos del diecinueve de octubre del dos mil seis.- In the case before us, the grounds for appeal do not challenge that issue, but instead refer to only one of the three requirements (possession); they do not address the legal basis that justified dismissing the complaint. Nor did the plaintiff demonstrate any possession in recent years. It should be noted that the two witnesses who testified, offered by the plaintiff, namely, [Nombre8], stated that the plaintiff’s father planted corn and rice and had a shack on the land, but that 25 to 30 years ago he abandoned it and never worked it again (minute 08:50 of the audio), and witness [Nombre9] stated that since the year 1989 he has passed by the property once a year and has not seen anyone working it (minute 17:07 of the audio).

This makes clear that the plaintiff has not exercised any possession sufficient to acquire ownership by prescription. This Tribunal concurs with the assessment of the evidence made in the challenged judgment, in light of Article 54 of the Ley de Jurisdicción Agraria, which establishes the system of free evaluation of evidence (libre valoración de la prueba), insofar as the plaintiff does not satisfy the requirement of good faith in possession. The grounds for appeal are rejected, and the challenged decision is affirmed.-

As to the matters appealed, the appealed decision is affirmed.- ????????????????

VOTO N° 1177-F-22 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las doce horas dos minutos del doce de diciembre de dos mil veintidós.- PROCESO ORDINARIO interpuesto por SUCESORIO DE [[Nombre1] ], [...], representado por su albacea [[Nombre2] ], [...]; contra [Nombre3] , pasaporte de los Estados Unidos de Norte América CED1 , vecino de Boca de Nosara. Intervienen como partes interesadas; la Procuraduría General de la República, representada por Mauricio Castro Lizano, mayor, casado, vecino de Heredia, cédula de identidad número CED2 - - , en su condición de procurador adjunto, y al Instituto de Desarrollo Rural, representado por Luis Diego Miranda Guadamuz, mayor, casado, abogado, vecino de Liberia, cédula de identidad número CED3 - - . Actúa como apoderada especial judicial de la parte actora la licenciada Wendy Vallejos Morales, colegiada once mil trescientos catorce. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Guanacaste.- Redacta el juez Picado Vargas; y,

CONSIDERANDO:

I - De las pretensiones: La parte actora solicita en sentencia se declare lo siguiente: 1.- Que se declare con lugar en todos los extremos Ya presente demanda Ordinaria de USUCAPION. 2.- Que se ordene la Prescripción negativa de los derechos de Restitución que pudieran tener el aquí demandado [Nombre3] . 3.- Que se declare, La existencia de los presupuestos de la Prescripción Positiva a favor de [[Nombre1] ], [...]. En relación a la propiedad ubicada en el Distrito de Primero Cantón de Nicoya Provincia de Guanacaste. Terreno para la agricultura, Lote 393, Tomo de Propiedad DOS TRES CUATRO TRES CINCO DEL PARTIDO GUANACASTE, Bocas de Nosara de Nicoya, colinda al NORTE: [Dirección1] , al SUR: [Dirección2] , al ESTE: [Dirección3] , al OESTE: Con [Dirección4] . Mide: sesenta mil setecientos cuarenta y cuatro metros con setenta y siete decímetros cuadrados, plano catastro G- 8925-69, dedicado a actividades agrícolas, por haberse probado en este proceso que ha poseído en forma Quieta, Pública, Pacífica, ininterrumpida, y a título de único y exclusivo dueño por más de treinta y seis años de buena fe, posesión que ha consistido en actos de Mantenimiento al inmueble, introduciendo mejoras tales construcción de un poso de agua para consumo humano, cultivo de Maíz, arroz y frijoles. 4.-Que se ordene, como consecuencia, ante el Registro Nacional, la titulación de la finca matricula CED4 DEL PARTIDO GUANACASTE, Bocas de Nosara de Nicoya, colinda al NORTE: [Dirección1] , al SUR: [Dirección2] , al ESTE: [Dirección3] , al OESTE: Con [Dirección5] .

Mide: sesenta mil setecientos cuarenta y cuatro metros con setenta y siete decímetros cuadrados, plano catastro [Placa1], dedicado a actividades agrícolas. LIBRE DE LIMITACIONES, EXCEPTUANDO LAS QUE POR LEY CORRESPONDAN. A favor de [[Nombre1] ], [...]. 5.- Que con el en de no causar graves e irreparables daños morales y patrimoniales a mi representado, debe enviarse mandamiento de anotación ante el Registro Nacional, del presente proceso, al inmueble DOS TRES CUATRO TRES CINCO DEL PARTIDO GUANACASTE, Bocas de Nosara de Nicoya. 6.- Que en caso de Oposición a la presente Demanda, por parte del aquí demandado [Nombre3] , condenarse al mismo cancelar al señor [[Nombre1] ], las mejores introducidas y en las eventuales costas procesales y personales de las partes involucradas en el presente proceso, condena que se hará eventualmente en abstracto, para una eventual ejecución de sentencia. PRETENSIÓN SECUNDARIA: 1) Que en caso de Oposición a la presente Demanda, el señor [Nombre3] , deberá cancelar al señor [[Nombre1] ], las mejores introducidas, y las eventuales costas procesales y personales, condena que se hará eventualmente en abstracto, para una eventual ejecución de sentencia. Sin embargo el señor [[Nombre1] ], continuará gozando de la posesión de dicho inmueble, hasta el pago de todos los conceptos señalados," (Ver exp descargado en modo pdf, imágenes 1 a 7).-

II.Excepciones deducidas: El demandado fue debidamente notificado y el cual no contesto demanda, por lo cual se le declaró rebelde mediante resolución de las diez horas y veintitrés minutos del veintinueve de noviembre del año dos mil diecinueve, (Ver exp descargado en modo pdf, imágenes 112 a 113 y acta de notificación en imagen 107).-

III.El juez Wálter Ávila Quirós mediante sentencia N° 266-2022 de las dieciséis horas veintisiete minutos del cinco de octubre de dos mil veintidós, resolvió: " De conformidad con las citas de hecho y de derecho se declara SIN LUGAR en todos sus extremos la demanda establecida por SUCESORIO DE [[Nombre1] ], representado por su albacea [[Nombre2] ] contra [Nombre3] . Se resuelve éste asunto sin especial condenatoria en costas", (Ver exp descargado en modo pdf, imágenes 240 a 247).-

IV. Se prohíja el elenco de hechos tenidos por demostrados por ser acordes al acervo probatorio-

V.Se comparte el cúmulo de hechos tenidos por no probados por encontrarse ayunos de elementos de prueba que los sustenten.-

VI.La parte actora apela la sentencia dictada según escrito agregado a la bandeja de escritos presentado el 10/10/2022 de las 6:34:01. a.m., manifestando lo siguiente: AGRAVIOS: "PRIMERO: Según lo indicado por los artículos 41 en el cual se indica que ocurriendo a las leyes todos seremos iguales en relación con el articulo 27 el cual indica que se garantiza la libertad de petición y el derecho a obtener pronta resolución ambos artículos de la Constitución Política de Costa Rica, se indica de forma dolorosa que este proceso y más aún la sentencia recurrida ha caído en una preterintención entendiéndose la misma como “una acción preterintencional es aquella que genera consecuencias leves de las que se pretendía provocar. Preterintención se emplea como sinónimo de preterintencionalidad. Ambas ideas provienen de la expresión latina praeter intentionem, que se refiere a actuar “más allá de la intención”.” Y por qué se indica esto, porque nótese que este expediente es del año 2019 y hasta ahora con la sentencia recurrida la parte actora a estado actuando en este proceso si contraparte toda vez que el demandado fue debidamente notificado pero hasta el día de hoy NUNCA se apersono y por mas que se solicito se declara su rebeldía nunca fue decretada en el proceso; por lo que se podría creer que este proceso se iba a llevar de una forma rápida al no existir oposición pero mi representada a tenido que luchar sola para hacer valer sus derechos de que se le cumpla un debido proceso, véase que un acto donde no debe existir contención alguna notificar a MINAET a la Procuraduría al INDER, un acto que en todo proceso agrario debe darse ya que es de ley, en la causa de marras a pesar de que se solicito en lugar de realizar dicho acto se dio un decreto de caducidad en contra de mi representado y por ende se tuvo que presentar el correspondiente recurso de apelación de fecha 01 de febrero del 2022 presentado a las 14:33:01 horas, el mismo fue resuelto me4diante la resolución de las 10:21 horas del 15 de marzo del 2022, ya se tenia tiempo solicitando se notificara a todas las Instituciones intervinientes de ley y se tuvo que perder tiempo en que se resolviera un recurso de apelación que nunca se debió de haber presentado, pero se debió presentar.

También debe verse que la parte actora debió de cambiar de representación legal toda vez que el abogado director que abrió este proceso murió, por lo que esta representación solicito como prueba para mejor proveer el testimonio de [[Nombre4] ] ya que el mismo con su testimonio iba a narrar de forma fehaciente como su abuelo es despojado de la propiedad en discordia por parte del demandado, él mismo indicaría cuales han sido los actos posesorios en los últimos tiempos, como el por ser el ultimo hijo del causante actor nació en dicha propiedad y demás aclaraciones que solo las podía dar una persona cercana al actor pero fue denegado porque el Juez A Quo indico que para eso estaba la prueba testimonial, y en la sentencia recurrida no se indico nada de la prueba documental aportada. Se lesionó a la parte actora con esta sentencia cuando en la misma no se valoro ni siquiera fue mencionada la prueba documental aportada.

Por lo expuesto se indica que la sentencia recurrida a ocasionado un daño mayor puesto que la misma considera que mi representada no defendió y demostró que la propiedad en cuestión es del causante toda vez que en vida don [[Nombre1] ] siendo un muchacho y otra época a sus 14 años llego a este lugar a trabajar y formar su familia, luego cuando se debe inscribir la propiedad por ser menor de edad se inscribe a nombre de su padre ( esta indicación la realizaron ambos testigos de que fue el causante con la familia que formo quienes llegaron a ese lugar a ocuparlo). SEGUNDO: Según el artículo 40 de la Ley de Jurisdicción Agraria se establece la forma en que se le debe dar traslado a la demanda donde se le debe apercibir al demandado que de no contestar algún hecho este se le tendrá por CIERTO, pero se entiende que relacionado dicho articulo con el numero 43 del mismo cuerpo legal en el mismo se establece cuando a un demandado se le debe declarar rebelde de oficio o a petición de parte y como se indicó en la conclusión de alegatos se reitera dicha posición en cuanto a lo siguiente: Según la resolución de las 15:09 horas del 6 de mayo del 2019 se le dio curso a la presente demanda siendo que al demandado se le previno en dicha resolución los alcances de NO contestar y que se le decretaría en estado de REBELDIA, siendo que al demandado dicho traslado de la demanda le fue notificado el día 10 de octubre del 2019 al ser las 11:30 horas, y hasta el día de hoy el Sr. [Nombre3] no realizo ningún acto procesal ni siquiera señalo lugar donde recibir notificaciones, y por parte de la representación legal de la parte actora desde el 8 de noviembre del 2019 se ha solicitado en varias ocasiones que se decrete al demandado en estado de Rebeldía.

Siendo que hasta esta sentencia recurrida es que el A Quo hace solo una indicación de que el demandado esta rebelde. En relación a lo anterior se debe tener presente el artículo 43 de la Ley de Jurisdicción Agraria en cuanto indica: “Artículo 43.- Si, vencido el término de emplazamiento, el accionante no contestara la demanda, el juez, de oficio, o a instancia de parte, procederá sin más trámite a declarar su rebeldía y el contumaz tomará el juicio en el estado en que se halle al momento en que se apersone……...” este articulo debe relacionarse con el artículo 32 de la misma normativa. Según la doctrina correspondiente a la REBELDIA la misma se entiende: “La rebeldía es una situación de hecho: el demandado no compareció. Basta constatar que, vencido el plazo para la contestación, el demandado no está personado al proceso, para que sea declarada por el juez.” Entonces se debe entender que la Rebeldía, al final generara una presunción simple en su contra que quiere decir esto que por lógica jurídica a pesar de que la Ley indica que no se tendrán por admitidos los hechos por parte del demandado rebelde por obvia lógica jurídica al no contestar la demanda en principio cuando el demandado puede contradecir los hechos alegados por el actor con la alegación de nuevos hechos o el ofrecimiento de prueba.

Y esto se hace en la contestación de la demanda entonces al ser declarado rebelde, es porque no contestó la demanda ni ofreció prueba alguna. Entonces en el caso de marras al no existir ni un solo acto en los procedimientos normales de este proceso pone al Juez en una situación difícil porque el aquí demandado no desvirtuó o contradijo los hechos de la demanda, que hubiera sido en el momento procesal oportuno que fue cuando se le dio el traslado de la demanda, pero en esta causa nótese que el demando NO participo en ninguna etapa del proceso, por lo que elimino de toda forma el contradictorio dejando como únicos hechos los alegatos en el escrito inicial de esta demanda. Por lo anterior se reitera la solicitud de que se tengan como reales, no contradichos, probados, no desvirtuados, los seis hechos que se indicaron en la presentación de la demanda todo en razón de que el propio demandado debe asumir su responsabilidad de NO ACTUAR o hacer uso de su derecho de defensa, y al tomar una posición de rebeldía asumió la presunción simple al no debatir ningún hecho que los mismos son ciertos, por ende así se solicita se tengan como ciertos todos los hechos de esta demanda, por lo aquí indicado.

Sobre la Rebeldía en el proceso agrario se debe analizar la jurisprudencia según la Sentencia 00337 del Tribunal Agrario del 29 de mayo de 1998 dentro del expediente 98-000337-0029 AG. TERCERO: La sentencia recurrida indica que mi representada de forma incorrecta pretende adueñarse de la parte que le corresponde a la Zona Marítima Terrestre, y de la demanda y el proceso se desprende de forma clara que mis representados solo les interesa recuperar la Finca Matricula Folio Real Numero CINCO- VEINTITRES MIL CUATROCIENTOS TREINTA Y CINCO- CERO CERO CERO, que es terreno para la agricultura situada en el Distrito primero Nicoya del Cantón dos Nicoya de la provincia de Guanacaste y que tiene los siguientes linderos: Norte: [Dirección6] , Sur: [Dirección7] , Este: [Dirección8], Oeste: [Dirección9] , tiene una medida de sesenta mil setecientos cuarenta y cuatro metros con setenta y siete decímetros cuadrados todo según el plano G-8925-1969.

No se entiende porque el Juez [Nombre5] y la Procuraduría indicaron que al sucesorio actor le interesa apropiarse de la zona marítimo terrestre cuando en ningún acto de este proceso se ha hecho indicación que se pretende adueñar de la misma, la parte actora solo le interesa recuperar la finca descrita, por favor revisar este expediente y así constatarlo. Se recalca que esta propiedad no esta dentro de ninguna reserva forestal o parque nacional y hasta el día de hoy la misma no ha sido objeto de expropiación por pate del Estado. CUARTO: La sentencia recurrida hizo omisión total sobre la prueba documental aportada ni tan siquiera para decir se aprobaba o no la misma, y hay un hecho probado de forma documental en e cual se indica que el demandado adquirió de forma fraudulenta la propiedad de marras y por ser un hecho probado documentalmente de forma amplia se solicito se testimoniara piezas para el Ministerio Publico y se determinara la existencia del dolo por lo que al no indicar nada sobre dicha prueba documental la sentencia recurrida viola el articulo 19 de la Constitución Política de Costa Rica donde se establece que todo extranjero debe cumplir las mismas obligaciones que cualquier nacional mientras no sea el ejercicio político.

De forma abundantemente clara expongo nuevamente dicha prueba documental: Consta que en el hecho primero de esta causa el traspaso con el cual se adjudicó la Finca 5-23435-000 el aquí demandado rebelde fue por medio de una escritura que contiene vicios de nulidad absoluta que encuadran en el ilícito penal de fraude, porque luego de analizarse el fondo de dicho traspaso a la luz de la prueba aportada por la parte actora se logra comprobar fehacientemente que el Sr. [[Nombre6] ] difunto padre del causante aquí actor quien era que custodiaba dicha propiedad porque el Sr. [[Nombre1] ] al momento de inscribirse dicha propiedad era menor de edad, se encontraba en sus últimos días de vida y en un estado de salud deplorable tanto que el mismo tenía demencia senil y otra enfermedades diagnosticadas y vistas por doctores de la Caja Costarricense del Seguro Social; es importante también indicar que en este expediente se aportó según la certificación emitida por el Registro Civil todas las firmas inscritas ante dicha institución por parte del Sr. [[Nombre6] ] para que la misma sea corroborada en la supuesta firma que se supone que realizo el Sr. [[Nombre6] ] para traspasarle dicha propiedad al aquí demandado rebelde.

Nótese que en el grave estado de salud que a pesar de que el Sr. [[Nombre6] ] sabía que no era el dueño real de dicha propiedad no pudo efectuar un acto legal para traspasarle de forma efectiva la propiedad a su dueño real quien es el aquí causante [[Nombre1] ] quien era su hijo, por lo que es ilógico creer que en vez de traspasarle la propiedad a su hijo se la traspase a otra persona ajena a un tercero con el cual no tenía una relación contractual para traspasar dicha propiedad, y esto en razón de que el Sr [[Nombre6] ] no tenía la capacidad cognoscitiva para realizar algún acto contractual con absolutamente nadie. Y llevando razón mi representada avalados en la normativa Constitucional que en cuanto a que las personas se sientan agraviados en sus derechos la misma Constitución los faculta a acudir a los Juzgados para hacer valer sus derechos y en todo proceso es el derecho de defensa y parte vital de este derecho es la prueba que la persona ofrece en su demanda, y aquí se ofreció de forma oportuna para demostrar este hecho como cierto y que además se debe indicar que no está controvertido la siguiente prueba que consta en autos: - Escritura numero 80 otorgada el 26 de febrero de 1999 - Epicrisis emitida por la Caja Costarricense del Seguro Social del estado tan deplorable de salud del Sr. [[Nombre6] ] con el cual se demuestra que el mismo n tenía la capacidad ni cognoscitiva o moral para realizar el traspaso al aquí demandado rebelde por lo que este traspaso es absolutamente nulo. - Copias de las escrituras 79, 80 y 81 del Lic. Luis Guillermo Espinoza Picón. - Certificación de las copias del legajo que confo9rman las solicitudes de cedula del Sr. [[Nombre6] ] QDDG, emitida por el Registro Civil de Costa Rica.

Por lo que se solicita se tenga esta prueba como cierta, no controvertida y que la misma avala que la escritura de traspaso que genero el título de propiedad del aquí demandado rebelde es invalida absolutamente. Por lo que procede testimoniar piezas para la Fiscalía de fraudes. QUINTO: Se aclara que los testigos hicieron indicación en que fue el Sr. [[Nombre1] ] quien entró en los años 60 o menos a poseer dicha propiedad porque así se hacia en aquellos tiempos el que necesitaba de la tierra la tomaba, los dos testigos indicaron que el Sr [Nombre7] tuvo su casa con pozo ahí se caso y tuvo sus hijos, luego el testigo [Nombre8] indico que lo último que los vio hacer fueron las rondas y el testigo [Nombre9] dijo que últimamente no sabría si han hecho algo en el lugar porque en razón de su edad y no va por el lugar ya que su casa está lejos, y se debe destacar que ambos testigos indicaron que el demandado nunca fue visto en la propiedad que se imaginan que es uno de los tantos extranjeros que llegaron a la localidad de Playa Guiones.

Y lo anterior con la prueba documental aportada se logra comprobar, reiterándose que la sentencia apelada no hizo indicación mínima de la misma, que la parte actora su causante indico que ah poseído por más de 40 años la finca inscrita bajo el Número de Folio Matrícula Real Numero 5-23435-000 inscrita bajo el plano G-8925-1969, por lo que se debe analizar los siguientes hechos que corresponden a derechos del actor de este proceso, los cuales se analizaran uno a uno: A- El plano que genero la inscripción de esta propiedad es del año 1969 cuando el ITCO institución que hoy en día es el INDER tenía la administración de estas tierras, y dicha institución en su momento no vio ningún hecho que imposibilitare otorgársele dicha finca a una persona física la cual en su momento de inscripción era quien ejercía la posesión de la misma. Por lo que debe concluirse que para esta institución estatal esta propiedad no estaba dentro de ninguna área protegida y hasta el día de hoy no existe por parte de ninguna institución gubernamental que esta propiedad este dentro de un área protegida o reserva forestal, avalada a esta indicación debe verse el acta de inspección del Juez Agrario en dicha inspección no consta que dicha propiedad se encuentre dentro del Parque Nacional Ostional además analizándose los límites, mojones, de dicho parque la propiedad se encuentra fuera de dicho parque de conservación silvestre para protección de las tortugas, también se debe avalar en la prueba testimonial donde el Juez le consulto a los testigos y los mismos indicaron que ahí no llegaban tortugas que eso era en Playa Ostional.

B- La Finca a usucapir a favor de la parte actora fue ampliamente analizada en el VOTO N°164- C-20 del Tribunal Agrario del Segundo Circuito Judicial de San José, en este voto se determinó que esta finca nació al ordenamiento registral legal de una forma conforme al derecho que en su momento el Estado ejerció mediante su actuación a través de las instituciones correspondientes, por lo que este proceso “…. CONSTITUYE UNA ACCION REAL DECLARATIVA DEL DERECHO DE PROPIEDAD SOBRE UN INMUEBLE INSCRITO…” Ahora bien se debe analizar lo anterior en conjunto según lo expuesto en el Libro Jurisprudencia de Derecho Agrario y Ambiental del Prof. Enrique Ulate Chacón, especialista en Derecho Agrario, pagina 274, Sentencia numero 171 Sala Primera de la Corte Suprema de Justicia, en la cual se indica sobre la Acción publiciana de mejor derecho de posesión y nulidad de venta de cosa ajena, en concordancia con lo estipulado en la página 291 del mismo libro Sentencia N|3 de la Sala Primera de la Corte Suprema de Justicia, Mejor Derecho, Restitución, Procedencia, Posesión Agraria por relación de parentesco.

Todo lo expuesto hasta aquí en este punto debe analizarse conforme a los hechos la parte actora ha ejercido los derechos de posesión sobre esta propiedad desde antes de que naciera en el Derecho Registral esta Finca siendo que el causante actor por no ser mayor de edad tuvo que apoyarse en su padre para registrar esta finca, y como ya se ha demostrado de forma absolutamente nula el demandado rebelde traspaso la finca que en realidad es una finca ajena al propietario registra y que por el estado de salud al momento de celebrarse dicha escritura el mismo no lo pudo indicar, pero la realidad es que el Sr [[Nombre1] ] , poseyó esta propiedad aquí tuvo su casa, aquí nacieron sus hijos, cultivaron esta tierra y que por el estado de salud de don [[Nombre1] ] sus hijos son los que siguieron con dicha posesión actos en los cuales son reparar cercas, tratar de limpiar la propiedad, el joven [[Nombre4] ] realiza actividades de pesca en dicha propiedad ya que luego de pescar utiliza a propiedad para limpiar lo que saca.

Por lo que debe declararse que la persona idónea porque le asiste mejor derecho de posesión y que acompaño al proceso de inscripción ante el Registro Nacional de la Propiedad, de esta propiedad inscrita es el Sr. [[Nombre1] ] y por ende hoy en día su sucesorio. Para concluir queda más que demostrado con la prueba testimonial que el demandado rebelde nunca poseyó esta propiedad que desde que esta propiedad era baldía fue poseída por don [Nombre7], por ende se debe decretar la usucapión positiva a favor del Sucesorio de quien en vida fuera don [[Nombre1] ], y que si se ventila este proceso en sede agraria es en razón de la materia porque es un fundo destinado por el Estado Costarricense con fin agrícola desde que nació en el Derecho Registral, y que de no haberse dado por parte del demandado rebelde un traspaso con nulidad absoluta para apropiarse de forma ilícita esta propiedad el aquí actor hubiera podido utilizar cualquier otro procedimiento legal que lo amparaba para registrar esta propiedad ya que para don [Nombre7] era su padre es decir su progenitor quien custodiaba de forma registral y no como lo ha tenido que hacer en este proceso en contra de un tercero de mala fe que nunca ha poseído, mas todo lo contrario el sucesorio actor si ha poseído esta propiedad desde que don [Nombre7] estaba vivo.

SEXTO: Se indica que para ejercer la acción reivindicatoria con éxito no basta ser propietario con base en el Registro Público de la Propiedad, pues ello implica una mera titularidad. Ser dueño significa haber ejercido en el bien reclamado los atributos del dominio, y en particular haber sido poseedor, demostrando la existencia de actos posesorios efectivos y estables conducentes a demostrar ser propietario en la realidad, sea por sí o por sus anteriores transmitentes. Ser dueño no significa solamente serlo conforme a un documento sino haber realizado además actos de ejercicio y de goce. En cuanto al ejercicio a través de actos de disposición y concretamente a través de una posesión, suficientes para demostrar que la protección judicial se da respecto de quien en un momento determinado tuvo completos todos los atributos del dominio, en forma plena.” (Resolución No. 241 de las 16 horas 25 minutos del 17 de julio de 1990, el resaltado es nuestro).

Lo anterior se encuentra en la Opinión Jurídica OJ-050-2006, por lo que se debe entender el demandado no ejerció ningún acto de reivindicación a su favor sobre la propiedad en marras porque el mismo sabe que su título de adquisición no fue obtenido de forma legal que dicho titulo traslativo tiene una nulidad absoluta la falta de voluntad del transmitente por cuanto el mismo no tenia capacidad mental para realizar dicho acto, el demandado también sabía que no podía demostrar su posesión véase que al adquirir lo que hizo fue una serie de actos para aumentar el tamaño de la propiedad de forma ilícita y por ende hoy dicha propiedad tiene una anotación de advertencia administrativa inscrita bajo las citas EXP. ADM 2011-00338-RIM, el demandado solo ha intentado hacer daño al aquí actor y al Estado de Costa Rica, por lo que no se le debe premiar su actuar lleno de mala fe, aquí se hace el llamado a esta Autoridad de hacer valer la justicia para mi representada por favor no dejar que personas extranjeras crean que pueden venir a nuestro país y actuar de esta forma.

El causante no vio motivo para creer que su propiedad corría riesgo el mismo en su condición de un humilde agricultor considero que al estar su propiedad inscrita a nombre de su padre ir más que suficiente para no perderla y aquí radico su buena fe, el titulo el causante se lo gano al entrar a poseer dicha propiedad a sus escasos 14 años él la cultivo con su familia y si luego para que a sus hijos les quedara más cerca una escuela se trasladó más adentro de Nosara pero ya existía un título de dicha propiedad a nombre de su padre y para el este título era suyo, si se hace una expedición a Playa Guiones se vera que la misma esta tomada por extranjeros que quedan pocos nativos pero los que aun quedan saben que esta propiedad es de don [[Nombre1] ] y sus hijos y es la comunidad de Playa Guiones que se pregunta por qué no está esta propiedad con sus reales propietarios, por lo dicho se ha demostrado tanto a nivel testimonial como documental que la parte actora desde que era un terreno baldío entre los años 50 y 60 don [[Nombre1] ] entro en esa maleza limpio y trabajo dicha propiedad aquí hizo su familia nacieron sus hijos, de forma pública, pacífica y a título de dueño y por ende cuando el ITCO en ese entonces inscribió don [[Nombre1] ] por cumplir n todos los requisitos a pesar de ser menor de edad cuando se inicio estos tramites se le dio la posibilidad de inscribir por medio de su representante legal su padre y así estuvo la propiedad inscrita hasta que de forma maliciosa y por medio de fraude el demandado rebelde tituló con nulidad absoluta dicha propiedad, por lo que no cabe más que reivindicar la propiedad a sus reales dueños los hoy herederos de don [[Nombre1] ] quienes al fin y al cabo nacieron en esta propiedad y ayudaron a su padre en las siembras y ya al final a realizar las rondas." (Ver exp descargado en modo pdf, imágenes 252 a 262).-

VII.Sobre sus agravios, no lleva razón el recurrente. En primer lugar, en materia agraria, a diferencia del proceso civil, la rebeldía del demandado no implica tener por ciertos los hechos de la demanda ni la obligatoriedad de declarar con lugar la demanda, ya que rige la legislación especial agraria, como lo es el artículo 41 de la Ley de Jurisdicción Agraria que indica que la falta de contestación de la demanda no implicará tenerlos por aceptados. Segundo, la declaratoria de nulidad del traspaso que hiciera en el año 1999 el padre del actor al demandado no es procedente, ya que no fue pedido en la demanda y no puede el actor, a estas alturas del proceso y por la vía recursiva, tratar de ampliar la demanda en cuanto a las pretensiones (artículo 35.6 del Código Procesal Civil, aplicado supletoriamente). En cuanto al resto de agravios, la demanda de usucapión fue rechazada principalmente porque el actor no ejerce posesión de buena fe, conforme a los artículos 853, 285 y 286 del Código Civil, ya que siempre ha tenido pleno conocimiento de que la finca en litis estaba inscrita en el Registro Público a nombre de su padre y posteriormente al año 1999, a nombre del demandado, por lo que su posesión no es apta para usucapir.

Este Tribunal en forma reiterada ha sostenido: “En cuanto al instituto de la USUCAPION AGRARIA Es necesario distinguir la usucapión especial agraria –regulada en la Ley de Tierras y Colonización, de la usucapión agraria común. La especial agraria, prescinde del justo título y de la buena fe, pues la misma Ley de Tierras, en su artículo 92 y 101 así lo establecen, pero exige la posesión agraria pública, pacífica, ininterrumpida, por más de diez años, sobre un terreno inscrito a nombre de un tercero, siempre y cuando los actos posesorios y la actividad agraria se realice para satisfacer necesidades propias o familiares. En la usucapión agraria común, en cambio, se exige además de los anteriores requisitos el justo título y la buena fe. Puede tratarse de una causa originaria (como el derecho de posesión) o derivada (mediante un contrato traslativo posesorio). Para el caso de la buena o mala fe, la primera se presume siempre, sin embargo, es poseedor de mala fe quien en el acto de la toma en posesión tuvo suficientes motivos para que dudara (artículos 284, 287 y 286 del Código Civil).

La buena o mala fe se liga al convencimiento de la persona de que está poseyendo un bien propio, y la persona que le trasmitió era su legítima propietaria.” Tribunal Agrario, Voto No. 1033-F-06 de las once horas veinticinco minutos del diecinueve de octubre del dos mil seis.- En el caso que nos ocupa, los agravios del recurso no atacan ese extremo, sino que se refieren a solo uno de los tres requisitos (posesión); pero no se centran en la razón jurídica que justificó se rechazara la demanda. Tamopco demostró posesión alguna en los últimos años, nótese que los dos testigos que declararon, ofrecidos por la actora, a saber, [Nombre8] afirmó que el padre del actor sembraba maíz, arroz y tenía un rancho en terreno, pero desde hace 25 a 30 años lo dejo abandonado y no lo volvió a trabajar (minutos 08:50 del audio), y el testigo [Nombre9] manifestó que desdeel año 1989 el pasa por el lugar una vez al año por la finca y no ha visto a nadie trabajar el inmueble (minuto 17:07 del audio), con lo cual queda claro que la accionante no ha ejercido posesión alguna para usucapir.

Este Tribunal comparte la apreciación valoratoria realizada en la sentencia impugnada, a la luz del artículo 54 de la Ley de Jurisdicción Agraria que establece el sistema de libre valoración de la prueba, en el sentido de que la actora no cumple con el requisito de buena fe en la posesión. Se rechazan los agravios y se confirma la resolución impugnada.-

En lo apelado, se confirma la resolución apelada.- ????????????????
