Decision: 2022-1773 Case File: 12-000340-278-PE (7) CRIMINAL JUDGMENT APPEALS COURT. Second Judicial Circuit of San José. Goicoechea, at seven thirty a.m. on December twelfth, two thousand twenty-two.
APPEAL filed in the present proceedings against Nombre01, who is of legal age, Costa Rican, holder of identity card number CED01, born in San José on October 09, 1957, son of Nombre02 and Nombre03, married, retired, and a resident of San José, for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of the FOREST HERITAGE. Judges Rosaura Chinchilla Calderón, Patricia Vargas González, and Kathya Jiménez Fernández participated in deciding the appeal. Enrique Montero Gamboa and Alex Manrique Ruiz Leal, both attorneys representing the Procuraduría General de República, appeared before this Court; and, BACKGROUND:
I.By oral judgment number 0691-2022, issued at 13:38 on April 27, 2022, the Criminal Trial Court of the Third Judicial Circuit of San José, sitting in Pavas, ruled: “Por tanto: In accordance with the foregoing; Articles 8 of the American Convention on Human Rights; 11.2 of the Universal Declaration of Human Rights; 9, subsection 2, and 14, subsection 2, of the International Covenant on Civil and Political Rights; Articles 36, 39, and 41 of the Political Constitution; Articles 1, 6, 9, 12, 142, 180, 182, 265, 267, 360, 361, and 363 through 366 of the Code of Criminal Procedure; and sections 58, 61, 62, and 33 of the Ley Forestal, applying the universal principle of in dubio pro reo, the accused and civil defendant Nombre04 is ACQUITTED OF ALL PENALTIES AND LIABILITY for the offense of ENCROACHMENT UPON A PROTECTED AREA AND ILLEGAL LOGGING, which he had been charged with committing to the detriment of NATURAL RESOURCES.
The civil claim for damages (acción civil resarcitoria) brought by the Procuraduría General de la República is denied, with no special award of costs. Any precautionary measure (medida cautelar) imposed against the accused in connection with these criminal proceedings is hereby vacated. There is no evidence requiring a ruling. It is ordered that certified copies of the relevant records (testimonio de piezas) be transmitted so that an investigation may determine whether a protection area (área de protección) was encroached upon through the construction of a single-family dwelling, in light of the contents of expert report DCF:2015-04347-BIO. By the oral issuance of this judgment, all parties are duly notified and may file an appeal against the judgment before the Criminal Judgment Appeals Court of the Second Judicial Circuit of San José. II.Enrique Montero Gamboa, attorney and representative of the Procuraduría General de República, filed an appeal against the foregoing ruling.
III.After the corresponding deliberation was conducted in accordance with Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal.
Judge Chinchilla Calderón authored the opinion; and,
CONSIDERING:
I.Procedural summary and admissibility. (A) The challenged judgment was issued in a remand trial (juicio de reenvío). Therefore, in order to verify remand jurisdiction (competencia de reenvío), that the criminal action has not become time-barred under the statute of limitations (prescripción de la acción penal), and compliance with the principles of impartiality of the court of first instance (a quo) and the appellate court (ad quem), the right to review by a higher court (doble conforme), and the prohibition against reformatio in peius (prohibición de reforma en perjuicio), it is appropriate to provide a brief procedural account of what occurred: i. By judgment 302-2021 at 09:00 hrs. on 07 de mayo de 2021, the Criminal Court of the Third Judicial Circuit of San José, Pavas seat, sitting as a single-judge court, ruled: “POR TANTO: In accordance with Articles 8 and 9 of the American Convention on Human Rights, Articles 39 and 41 of the Political Constitution, Articles 209 and 216 of the Criminal Code, and Articles 1, 6, 9, 30 subsection e), 31, 33, 34, 142, 180, 311 subsection d), and 340 of the Code of Criminal Procedure, a FINAL DISMISSAL DUE TO TERMINATION OF THE CRIMINAL ACTION (SOBRESEIMIENTO DEFINITIVO POR EXTINCIÓN DE LA ACCIÓN PENAL) is entered in favor of Nombre04 for the offense of VIOLATION OF THE LEY FORESTAL with which he had been charged to the detriment of THE FOREST HERITAGE.
The costs of the proceedings shall be borne by the State. NOTICE SHALL BE GIVEN.” ii. The Deputy Attorney General filed an appeal, and this Court, composed of Judges Quesada Salas and Corrales Pampillo and Judge Gillen Bermúdez, by judgment 2021-1066 at 08:30 hours on 19 de julio de 2021, ruled: “POR TANTO: The appeal filed by the representative of the Office of the Attorney General of the Republic is granted, the decision under appeal is declared ineffective, and the matter is remanded to the original criminal court so that, with a different composition, it may assess the relevant issues on the basis of a correct determination of the structure of the criminal offenses under which, according to the accusation, the facts fall, and determine whether or not the asserted ground for termination applies in the present case. NOTICE SHALL BE GIVEN.” iii. On remand, a judgment of acquittal (absolutoria) was issued, which is the decision challenged here, as to both criminal and civil liability, since the State acts in a dual capacity, as private prosecutor (querellante) and civil plaintiff (actor civil).
(B) Attorney Enrique Montero Gamboa, counsel for the Office of the Attorney General of the Republic, filed an appeal against the judgment entered in these proceedings, a decision subject to challenge through this avenue (objective appealability (taxatividad objetiva)). This challenge was submitted by means of a reasoned brief filed with the trial court within the statutory period, as it was transmitted by fax on 18 de octubre de 2022 at 03:23 pm (see folio 384). Because the full judgment was issued on 27 de setiembre de 2022 (see folio 382), the period of 15 business days did not expire until 18 de octubre de 2022 and, therefore, in principle, the appeal would be admissible, since the appellant has standing to file it (subjective appealability (taxatividad subjetiva)), with no further formalities being necessary because otherwise the mandate established in Article 8.2.h of the American Convention on Human Rights and the ruling of the Inter-American Court of Human Rights in Nombre05 v. Costa Rica, judgment of 02 de julio de 2014, would be violated.
Nevertheless, an additional consideration is required: this is the second judgment exonerating the defendant from both forms of liability (civil and criminal) challenged by the private prosecutor, which makes it necessary to set out certain considerations regarding the doctrine of “concurrent acquittals” (doble conforme). Indeed, the record shows that an initial judgment ordered the dismissal of the accused (encartado), and that decision was challenged by the State’s representative. In response, this Court, sitting with a composition different from the current one, granted the appeal, vacated the judgment, and ordered a remand as to those matters. Now, the result is the same with respect to the criminal acts sent for a remand trial—a criminal acquittal—and only the private prosecutor appeals. May the prosecuting party twice appeal a judgment rendered at trial that releases the accused from liability?
May a dismissal (sobreseimiento) be treated as equivalent to an acquittal for these purposes? It is necessary to review what has occurred in Costa Rica in this regard. To determine this issue, it should be noted that Law N° 8503, known as the Opening of Criminal Cassation Law (Apertura de la Casación Penal), effective upon its publication in La Gaceta number 108 of 6 de junio de 2006, added Article 451 bis to the Code of Criminal Procedure. That provision became Article 466 bis through the inclusion of a series of articles by Law N° 8720, or the Law for the Protection of Victims, Witnesses, and Other Participants in Criminal Proceedings (Ley de Protección a Víctimas, testigos y demás sujetos intervinientes en el Proceso Penal), and read as follows: “Article 466 bis.- Remand trial. The remand trial shall be held by the same court that issued the judgment, but composed of different judges.
The Public Prosecution Service (Ministerio Público), the private prosecutor, and the civil plaintiff may not file an appeal in cassation (recurso de casación) against a judgment issued in the remand trial that repeats the acquittal of the accused ordered in the first trial, but they may do so with respect to the civil action, restitution, and costs. An appeal in cassation filed against the judgment from the remand trial shall be heard by the respective Court of Cassation, composed of judges other than those who ruled on the prior occasion. If it is not possible to compose the court with new judges because the disqualification applies to both regular and alternate judges, or because there are not enough alternate judges, jurisdiction shall be assumed by as many regular judges as are necessary, notwithstanding the ground for disqualification and without disciplinary liability on their part.” Under that provision, among other things, an appeal in cassation—the only means of challenging a criminal judgment at that time—was inadmissible against a judgment that acquitted the accused for a second time.
Article 466 bis of the Code of Criminal Procedure embodied the principle of concurrent acquittals or single prosecution (doble conformidad o única persecución), whose purpose is to limit the State’s punitive power so that persons are not subjected to endless criminal proceedings, undergoing trial repeatedly until the desired judgment of conviction is obtained. Through that provision, every person subjected to criminal proceedings was guaranteed that, if acquitted again after a second trial, that person would not have to face a new trial, since the second judgment of acquittal could not be appealed. That article was repealed by Article 10 of the Law Creating the Appeal Against Judgments, Other Reforms to the Appellate System, and Implementation of New Rules on Oral Proceedings in Criminal Cases (Ley de Creación del Recurso de Apelación de la Sentencia, otras Reformas al Régimen de Impugnación e Implementación de Nuevas Reglas de Oralidad en el Proceso Penal), N° 8837 of 3 de mayo de 2010.
However, it was reinstated by the Constitutional Chamber when it granted the constitutional challenge (acción de inconstitucionalidad) number 12-007781-0007-CO, filed against the aforementioned provision, ruling by decision N° 2014-13820 of 20 de agosto de 2014 at 16:00 hours (binding erga omnes) that: “The Public Prosecution Service, the private prosecutor, and the civil plaintiff may not file an appeal in cassation against a judgment issued in the remand trial that repeats the acquittal of the accused ordered in the first trial, but they may do so with respect to the civil action, restitution, and costs.” It expressly recognized that this doctrine is an instrument limiting the State’s punitive power and a right of the accused to be tried within a reasonable time, safeguarding not only the right to prompt and effective justice but also the principle of progressivity (principio de progresividad).
Although that provision originally applied for purposes of an appeal in cassation, in this Chamber’s view, a harmonious interpretation requires understanding the context in which it was enacted in 2006, since at that time an appeal in cassation was the only means of challenging criminal judgments. With the creation of appeals in criminal matters, the appeal is now precisely the ordinary avenue for challenging a criminal judgment; therefore, although the provision refers to an appeal in cassation, under the current framework of criminal-procedure law, its specific application must be understood to relate to an appeal. Despite this, the Constitutional Chamber subsequently, by majority vote, through an ex officio clarification in judgment N° 2014-17411, modified the content of judgment number 2014-013820, thereby effectively reversing its own ruling (without stating so and without such a course being permissible), and limited the applicability of this doctrine exclusively to appeals in cassation, thus making it impossible to apply a provision that remains in force by order of the Chamber itself.
Thereafter, several judicial requests for constitutional review (consultas judiciales de constitucionalidad) were submitted both by this judicial panel, with a composition partially similar to its current composition (decision number 02-2016: Nombre06 and Nombre07), and by other Criminal Judgment Courts of Appeal in the country (in matters involving adults and minors). On those occasions, the latter courts maintained that this change in constitutional precedent—made by means of an addendum while leaving the initial decision intact—: a) violated the principle of legal certainty, as well as every person’s fundamental right to be tried within a reasonable time and to limit the State’s punitive claim to reasonable means and time periods; b) Was incompatible with the current appellate system because it is not possible to challenge directly by an appeal in cassation a judgment of the trial court acquitting the accused for a second time, given that trial judgments are challenged by appeal and there is no per saltum cassation under any circumstances.
In submitting those judicial requests for constitutional review, it was stated that the Constitutional Chamber failed to consider that, under Law 8503 of 6 de junio de 2006, the appellate system was different and trial-court judgments could be challenged only by an appeal in cassation; therefore, when the appellate system changed, in order to remain consistent with its prior ruling concerning the doctrine of concurrent acquittals, it should have stated that the doctrine must be interpreted to mean that no appeal may be filed against a trial-court judgment that has repeated the acquittal of the accused; c) disregarded the principle of progressivity, which prevents the removal from a legal system of previously conferred rights that broaden the scope of guarantees protecting the fundamental rights enshrined in the Political Constitution or in the Human Rights Conventions, all of which had also been recognized in majority judgment number 2014-013820 of the Constitutional Chamber.
Nevertheless, most of those requests were declared inadmissible by the constitutional court (see decisions numbers 2015-9884, 2015-9886, 2015-9965, 2016-1210, 20126-2380, 2016-3477, 2016-4919 and 2017-16725), while others were made contingent upon other decisions (see decisions numbers 2016-9452 and 2016-9453). At the same time, a constitutional challenge was filed and resolved through judgment number 16967-16 at 10:42 hours on 16 de noviembre de 2016, in which the majority denied the challenge and stated: “This Chamber has already ruled, through decisions 2014-013820 and 2014-017411, that the reinstatement of Article 466 bis of the Code of Criminal Procedure refers only to appeals in cassation, and the provisions therein may not be extended to appeals.” Later, through decision number 2018-007208 of 09 de mayo de 2018, the constitutional court reaffirmed: “The request is answered to the effect that the reinstatement of Article 466 bis of the Code of Criminal Procedure refers only to appeals in cassation, and the provisions therein may not be extended to appeals.
Justices Castillo Víquez and Rueda Leal provide additional reasons. Justice Hernández López and Justice Hernández Gutiérrez dissent and would answer the consultation presented by stating that Article 466 bis of the Código Procesal Penal is not unconstitutional, provided it is understood that the only interpretation consistent with constitutional law is that no appeal whatsoever may be filed against the second criminal acquittal regarding the determination of criminal liability.” (Emphasis added). Although this Chamber unanimously considered that the majority decision of the Constitutional Chamber was not legally correct (because it disregarded the principle of progressive realization of human rights by making the situation of a person acquitted twice at trial more burdensome; because it affected the principle of legal certainty as a result of the change in the appellate system; and because a substantive ruling could not be modified by means of clarification), it could not depart from that decision, insofar as it had already been expressly and clearly reiterated by that majority of the constitutional justices and there was no higher-ranking (conventional) standard to which reference could be made.
Therefore, pursuant to Article 13 of the Ley de la Jurisdicción Constitucional, that precedent had to be applied and the appeal declared admissible. While this was occurring, the Third Chamber (in decision number 2019-62) dismissed the cassation appeals (casaciones) filed against the rejection of appeals that, in the view of other sections or criminal judgment appellate courts, were indeed inadmissible. At the same time, two bills were pending before the Legislative Assembly (legislative files numbers 19906 and 19908), which sought to amend the aforementioned legal mechanism so as to restore its original scope and thereby comply with the constitutional decisions regarding the statutory-reservation requirement (reserva de ley). Lastly, by Law 10200 of 05 de mayo de 2022, effective as of its publication, which occurred in La Gaceta No. 100 of 31 de mayo de 2022 (that is, before the date this judgment was issued), an amendment to provision 466 bis of the Código Procesal Penal was approved so that it would read as follows: “Article 466 bis—Retrial following remand (juicio de reenvío).
The retrial following remand shall be conducted by the same court that rendered the judgment, but composed of different judges.//The Public Prosecution Service, the private prosecutor (querellante), and the civil plaintiff (actor civil) may not file an appeal against a judgment of the Trial Court rendered in a retrial following remand that reaffirms the acquittal of the accused ordered in a previous trial.//In the situation described in the preceding paragraph, the corresponding remedies may be filed with respect to the civil damages action (acción civil resarcitoria), restitution, and costs.” (Emphasis added). Consequently, the appeal filed may be admitted for review only with respect to civil matters, restitution, and costs (if those were the matters alleged), because the exoneration from criminal liability is final and may not be challenged. Although the previous ruling referred to it as a “dismissal with prejudice” (sobreseimiento) rather than an acquittal, both decisions have the same effects and were issued at the trial stage.
Finally, regarding the application of the double-conformity guarantee (doble conforme) to civil matters, this Chamber, with the same composition, has stated as follows: “It follows from Article 466 bis reproduced above that although the civil plaintiff likewise may not file an appeal against the acquittal rendered in the retrial following remand when it reaffirms the acquittal of the accused ordered in a previous trial, an appeal is available with respect to ‘the civil damages action, restitution, and costs’ (emphasis not in the original). In other words, although no appeal may be filed concerning the decision in the criminal sphere, the situation is different in civil matters. It bears noting that, when addressing the civil damages action, the Code itself provides for the distinction that must be drawn between the ‘acquittal’ and the ruling on a validly asserted civil action, where appropriate (see, for example, Article 40 of the C.P.P.).
This is understandable when it is considered that the prerequisites for civil liability differ from those for criminal liability. As Professor Llobet Rodríguez explains, ‘Fundamental to civil liability is the existence of harm that must be borne by a natural or legal person on the basis of a ground for attribution that obligates that person to undertake reparation of the harm. It must be borne in mind that criminal liability is governed by the principle of culpability, requiring the conduct committed to satisfy the elements of an offense, be unlawful, and be culpable. This is not required for civil liability, which even establishes various instances of strict civil liability. Civil liability may therefore exist even when criminal liability does not’ (Llobet Rodríguez, Javier. Proceso Penal Comentado. Código Procesal Penal Comentado. San José: Editorial Jurídica Continental, 6° edition, 2017, p. 152).
This passage explains why the term acquittal, for purposes of the aforementioned Article 466 bis, is understood to refer to a decision concerning the criminal action rather than civil matters. Likewise, although the civil plaintiff may not appeal the former (the acquittal) when it reaffirms a prior acquittal rendered at trial, the civil plaintiff may appeal, insofar as relevant here, the ruling on the civil claim.” (Decision 2022-0882 at 07:40 hours on 20 de junio de 2022). (C) Requirements for restitution. Although, as will be discussed, this Chamber agrees that the appeal is proper in this matter, there is disagreement concerning the arguments and requirements supporting that conclusion. (C.1) Majority position (Judges Chinchilla and Jiménez). It is important to bear in mind that restoration of things to their original condition is not merely an interim criminal measure (medida provisional penal) (unlike restoration of things to their prior condition, as provided in provision 140 of the Código Procesal Penal), but rather forms part of the civil claims asserted in this case by the appellant, who is the civil plaintiff, and such restoration is ordered in the final judgment (not during the investigation stage).
This was stated in decision number 2016-633 (Nombre08, R. Chinchilla and Nombre09), which held that the legal basis for this relief is found in Article 103 of the Código Penal, which provides, insofar as relevant: “Every punishable act entails civil reparation, which shall be determined in a judgment imposing liability; that judgment shall order: 1) Restitution of the property or, failing that, payment of its corresponding value (...)”. This provision must be read in context in order to arrive at an interpretation consistent with what the legislature intended. Its placement in the Código Penal, under Title VII, entitled “Civil Consequences of the Punishable Act,” means that it is directly related to the civil claim pursued by the victim of a punishable act. Moreover, all three subsections are subject to the determination of “civil reparation” in the judgment (there is extensive academic debate as to whether forfeiture (comiso) is a civil consequence of the act; nevertheless, because that issue has not been challenged here, this Chamber will not address it).
In connection with the foregoing, provision 122 of the Reglas Vigentes sobre Responsabilidad Civil clarifies that this type of reparation includes “1° Restitution of the property,” confirming that, when this form of relief is referenced, it must indeed be regarded as a civil consequence of the act. Article 103, cited above, requires the court, in a judgment imposing liability (understood to mean civil liability, because such liability is independent of criminal liability: Article 40, in fine, of the Código Procesal Penal), to rule on restitution of the property (and provision 491 of the Código Procesal Penal reaffirms its civil compensatory nature by stating that, if a dispute exists, the interested persons shall be referred to the civil courts). Based on all the foregoing, it is concluded that restoration of things to their prior condition is among the remedies that may be ordered when civil liability is imposed (this must be distinguished from the mere restitution of property, which is ordered in the judgment when the object of the offense must be returned to its lawful owner or possessor and is generally being held under provisional custody).
However, the immediate question is whether the court may impose civil liability on the accused without a request from one of the parties, on its own motion (de oficio). Under Article 368 of the Código Procesal Penal, a ruling imposing civil liability may be issued only if the civil damages action has been asserted in accordance with Articles 37 to 41 of that same body of law. Likewise, provision 111 of the procedural code states: “To pursue the damages action, the holder thereof must appear as a civil plaintiff (...)”. The complaint setting forth claims for reparation or for restoration of things to their prior condition must satisfy a series of requirements, including, under Article 112 of the aforementioned Code: “d) The grounds on which the action is based, specifying the capacity invoked and the harm for which reparation is sought, even if the amount is not specified.” These claims must be particularized pursuant to Article 308 of the Código Procesal Penal, which states: “When the civil damages action has been asserted, the Public Prosecution Service shall also notify the civil plaintiff of the accusation so that, within five days, the civil plaintiff may particularize the claims, specify the type and form of reparation sought, and calculate the amount of damages and losses believed to have been suffered up to that time (...)”.
Accordingly, the purpose of the hearing afforded is to allow the civil plaintiff to define the specific relief sought in accordance with the complaint filed, which must of course include restitution if that is among the plaintiff’s interests. Therefore, the claim seeking restoration of things to their prior condition cannot be deemed capable of being ordered on the court’s own motion, because civil relief must be granted on the basis of what was requested in the corresponding complaint. In this case, a civil damages action was asserted; for this reason, together with what will be added below, the complaint on appeal may properly be considered. (C.2) Position of Judge Vargas González. As I stated in the dissent contained in decision 2021-0921 at 8:35 hours on 23 de junio de 2021, issued by this Chamber with a similar composition (R. Chinchilla Calderón, L. Murillo Mora, and P. Vargas González), «[…] restoration of things to their original condition is not a civil consequence arising from the punishable act, but rather a sui generis consequence that must be ordered by the court on its own motion, that is, regardless of whether there is a judgment imposing liability or even a civil damages action, based on provision 366 of the Código Procesal Penal.
In this regard, this Chamber, with a composition similar to the present one (Nombre10, Vargas González, and Murillo Mora), has stated as follows: “The challenge raised by defense counsel, arguing that restitution may not be ordered when the accused is acquitted criminally and no civil damages action has been asserted, is not novel, as this appellate court has already had occasion to rule on the matter and does not share that position.
Thus, based on the express provisions of Article 366 of the Código Procesal Penal (which is a provision enacted after Article 103 of the Código Penal, cited by the appellant in support of her position), the case law has interpreted that even where the judgment is an acquittal as to the criminal claims, the adjudicator is empowered to order—even sua sponte—the restitution of the objects involved in the proceedings: “[…] The judgment contains an error regarding the legal basis for ordering the eviction (desalojo), because the provision authorizing that measure is not Article 142 of the Código Procesal Penal, but rather Article 366 thereof. It expressly provides: ‘A judgment of acquittal shall order…the restitution of objects involved in the proceedings that are not subject to forfeiture (comiso)….’ In this specific case, the Tribunal found it proven that the land occupied by the defendants belongs to the State and is used by the Ministerio del Ambiente y Energía as part of the Proyecto de Ordenamiento Territorial Zona Núcleo del Refugio de Vida Silvestre Barra del Colorado.
Neither mere possession nor a right of possession may be asserted over such lands, insofar as they are outside the stream of commerce and are not subject to acquisitive prescription (Art. 262 of the Código Civil and Judgment 733-F-00, issued at 15:12 on October 4, 2000, by the Sala Primera de la Corte Suprema de Justicia). Once ownership of the parcel and its designation for nature conservation were established, the legal consequence was the removal of the occupants, as ordered in the judgment […]” (cf. Tribunal de Casación del Segundo Circuito Judicial de San José, decision N° 2004-00933, issued at 11:00 on 09 de setiembre de 2004). Likewise, still based on the provisions of Article 366 of the Código Procesal Penal, restitution of things to their prior condition has been deemed appropriate even when an acquittal is entered, where an infringement involving the maritime-terrestrial zone (zona marítimo terrestre) has occurred (cf.
Tribunal de Casación del Segundo Circuito Judicial de San José, decisions 2004-0919 and 2004-0933). This solution has even been adopted in the case of an acquittal for the offense of unlawful occupation (usurpación): “[…] if, according to the proven facts, the defendant here is occupying a parcel that was possessed by another person, the appropriate course is to order restitution in the same judgment, so as not to needlessly delay the injured party’s return to the property. In this regard, in a 1992 judgment involving a proven act of unlawful occupation, our Sala de Casación stated as follows: ‘It must be acknowledged that, in cases such as this one, the optimal course is for restitution of possession to be ordered in the same judgment imposing a conviction for the offense of unlawful occupation, so as not to needlessly delay the injured party’s restoration to the de facto control through which that party exercised dominion and will over the unlawfully occupied property.
Nevertheless, if such an order is omitted from the judgment, nothing prevents the subsequent issuance of a ruling that—in enforcement of that conviction—orders the unlawful occupant’s eviction from the property so that the injured party may take possession thereof, as occurred in the case under review. It bears noting that this solution not only follows from the proper application and understanding of the law, but is also compelled by the most elementary rules of common sense: it would be absurd for the defendant, relying on the judgment convicting him of the offense of unlawful occupation, to legitimize and retain possession of the very property he entered in a manner meeting the statutory elements of the offense, unlawfully and culpably.’ Sala Tercera de la Corte Suprema De Justicia, V-107-F, issued at eight fifty-five in the morning on the third day of April, nineteen ninety-two.—This judgment applies to the case at bar, not only because it warns against maintaining a legal absurdity, which would arise if someone were acquitted of unlawful occupation because she held a mistaken belief that she had a superior right to possess the property and obtain lawful title to it, and were then allowed to remain in possession until the injured party’s superior right of possession was established, even though the latter had acquired the right to possess that property despite any evidentiary and transactional difficulties that might exist.
The evidence presented, as well as the defense counsel’s technical and legal arguments, support the position of the trial adjudicator and of this Tribunal that, in this case, the parcel must be vacated and that, if Ms. Nombre11.Nombre12. believes that her right should prevail, she must assert it in another forum, whether civil or agrarian, depending on the nature and use of the property. Based on the foregoing, the order restoring the property to Ms. Nombre13. could not even be construed as a penalty (whether criminal or civil), but rather as a natural and logical consequence of the evidence presented at trial […] Accordingly, notwithstanding the acquittal entered on the criminal charge, the trial judge was required to order that the holder of title to the property in dispute be placed in possession thereof because she had a superior right of possession. In this regard, it is understood that, in most cases, the disputed property is in the possession of the acquitted defendant; therefore, if it is established that title thereto belongs to a third party (as occurred here), it must be restored to that party. […] Article 366, paragraph 1, of the Código Procesal Penal provides that the judgment, even if it is an acquittal, shall order the restitution of objects involved in the proceedings that are not subject to forfeiture, without specifying that such restitution must be made in favor of any particular person.
This therefore means that, for those purposes, the adjudicator must determine who has the superior right to the object, even if that person is a third party. Although this provision might be construed as referring not to real property but merely to “objects” (movable property), that position must be rejected, not only because forfeiture also applies to properties (Article 465 of the Código Procesal Penal), but also because Article 140 thereof establishes that, at any stage of the proceedings and at the injured party’s request, the judge may order, as a provisional measure, restoration of things to the condition in which they existed before the act. If the adjudicator has this authority as a provisional measure, there is all the more reason why it may be ordered as definitive restitution upon issuance of the judgment on the merits, once it has been determined that a particular person holds title to the property.
Furthermore, it must be reiterated that the order restoring the property to Ms. Nombre13. could not even be construed as a penalty (whether criminal or civil), but rather as a natural and logical consequence of the evidence presented at trial, which established that she acquired it in 1999 and has exercised possession over it since then. In this regard, Article 366, paragraph 1, discussed above, which requires the judge to issue the corresponding ruling on this matter, establishes that such a decision is sua sponte, because an order of restitution does not require, as a precondition, that the injured party have brought a civil action for damages (acción civil resarcitoria), or that the party have asserted a direct and express claim in that regard. The fact that, even though it is unnecessary, the injured party brings such an action (through which a ‘judgment’ ordering restitution could be obtained pursuant to Article 464 of the Código Procesal Penal) in no way means that the civil action was necessary.
For the foregoing reasons, the appeal is denied […]” (cf. decision of the Tribunal de Casación Penal del Segundo Circuito Judicial de San José N° 2006-1115, issued at 09:18 on 20 de octubre de 2016, which in turn cites and relies upon decision of the Sala Tercera de la Corte Suprema de Justicia N° 107-F-92, issued at 08:55 on 03 de abril de 1992). Likewise, to the effect that restitution is appropriate even where no civil action for damages has been brought, see decisions of the Sala Tercera N° 1462-2004 and N° 604-F-91. In light of the foregoing, it should be clarified that, obviously, restitution may be ordered whenever that measure is materially possible, as will occur, for example, when movable property is in the custody of the court office (cf. the situation governed by Article 367 of the Código Procesal Penal). Similarly, with respect to real property, restitution (if appropriate) will always be feasible, insofar as the judicial authority may appear at the property concerned and, through a formal act, place it in the possession of the person legally entitled thereto.
Clearly, that option would not be possible in cases involving movable property whose whereabouts or continued existence are unknown because it was neither seized nor placed in provisional custody; in such a case, the appropriate subsidiary measure would be monetary compensation through an award of damages […]” (Resolution N° 2018-0095, issued at 9:44 on 30 de enero de 2018, emphasis supplied). For the foregoing reasons, it is concluded that restoration of the protection area (área de protección) to its original condition is not contingent upon the conviction of the accused. Moreover—contrary to the appealed judgment’s conclusion—the fact that some persons have for years encroached with impunity upon the protection areas designated by the legislature, and that municipal and State authorities have tolerated this situation instead of fulfilling their duties, does not alter the fact that the courts, where appropriate, are required to order such restoration, because the right to a healthy and ecologically balanced environment is a fundamental right of those who inhabit this country, and the State must guarantee and defend it.” As I stated then, I believe that, given its sui generis nature, restoration of things to their original condition may be ordered even in the absence of a criminal conviction or where no civil action for damages has been brought.
Except on this point, regarding which the other members of this Tribunal hold a different position, I agree with them that the decision adopted by the court below lacks adequate reasoning and must therefore be vacated. (C.3) Nevertheless, whether one proceeds from the majority or minority position, the appellant did bring the civil action in this case, and therefore that dispute has no bearing on this specific case.
II.In the sole ground of the appeal (recurso), counsel for the State argues that the judgment fails to apply section 50 of the Political Constitution because it does not order restoration to the previous condition (restitución de las cosas a su estado anterior), even though the serious environmental damage was proven and the place where it occurred was delineated. He notes that recital IV (minute marker 15:37) refers to earthworks (movimiento de tierra) for a road carried out on the property and the felling of four trees of various species within the protection area of two springs (nacientes), one of which is permanent, despite which “neither criminal nor civil liability for the acts is determined,” because it was not proven that the work had been ordered by the accused. According to the appellant, at minute 28:38 it is stated that restoration cannot be carried out because the trees were felled and the road was built, without providing further details.
The appellant states that such restoration derives from section 41 of the Constitution and section 103 of the Criminal Code. He cites judgments 52-F-1990 and 2022-437 of the Third Chamber in support of strict civil liability (responsabilidad objetiva civil) in environmental matters. He adds that the decision is incomplete and contradictory because, despite finding the damage proven, it states that such restoration cannot be undertaken, but provides no further reasoning. He requests that restoration be ordered directly or, in the alternative, that the judgment be annulled insofar as it fails to rule on that issue and that the case be remanded. No response from the opposing party appears in the record. The appeal must be granted unanimously. In this matter, the appellant focused its argument on the refusal to order restoration to the previous condition, and therefore the appeal falls within the admissibility limits referenced above.
The court dismissed the civil action (acción civil) and the requested restoration even though, as the appellant correctly notes, beginning at minute 28:38 it acknowledges that environmental damage occurred (trees were felled and a road was built in protection areas) and, without further reasoning, refers to the impossibility of restoring matters to their previous condition, implying—because this is not expressly stated either—that since the road had already been built or the trees felled, it was impossible to prevent this, but without examining other possibilities, such as reversing that work or planting similar species. This failure to provide reasons (omisión de motivación) affects the validity of the judgment, as stipulated in section 142 of the Code of Criminal Procedure, because the right of access to justice set forth in article 41 of the Political Constitution requires a thoroughly reasoned ruling on all the parties’ requests, and the matter at issue here arises from strict liability (responsabilidad objetiva) established both constitutionally and by law to protect the right to the environment, which was likewise not examined.
Consequently, with respect to the omitted issue—specifically, the civil claims of the Procuraduría General de la República—the proper course is to order a remand for a new trial (juicio de reenvío), so that the matter may be heard and decided as required by law. In all other respects, the judgment remains undisturbed.
POR TANTO:
The appeal filed by attorney Enrique Montero Gamboa, representative of the Procuraduría General de República, is granted. The challenged judgment is partially annulled solely insofar as it denies restoration to the previous condition, and on that issue the case is remanded to a newly constituted trial court. In all other respects, the judgment remains final. NOTICE SHALL BE GIVEN.

Resolución: 2022-1773 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las siete horas con treinta minutos del doce de diciembre de dos mil veintidós.
RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra Nombre01, quien es mayor de edad, costarricense, con cédula de identidad número CED01, nacido en San José, el 09 de octubre de 1957, hijo de Nombre02 y de Nombre03, casado, pensionado, vecino de San José; por el delito de INFRACCIÓN A LA LEY FORESTAL en perjuicio de PATRIMONIO FORESTAL. Intervienen en la decisión de los recursos, las juezas Rosaura Chinchilla Calderón, Patricia Vargas González y Kathya Jiménez Fernández. Se apersonaron en esta sede el licenciado Enrique Montero Gamboa y el licenciado Alex Manrique Ruiz Leal ambos representantes de la Procuraduría General de República y,
RESULTANDO:
I.Que mediante sentencia oral número 0691-2022 de las 13:38 horas del 27 de abril de 2022, el Tribunal Penal del Tercer Circuito Judicial de San José, sede Pavas, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 8 de la Convención Americana de los Derechos Humanos; 11.2 de la Declaración Universal de los Derechos Humanos; 9 inciso 2 y 14 inciso 2 del Pacto Internacional de Derechos Civiles y Políticos, artículos 36, 39 y 41 de la Constitución Política; 1, 6, 9, 12, 142, 180, 182, 265, 267, 360, 361, 363 al 366 del Código Procesal Penal, ordinales 58, 61, 62 y 33 de la Ley Forestal en aplicación del principio universal In Dubio Pro Reo, se ABSUELVE DE TODA PENA Y RESPONSABILIDAD al acusado y querellado Nombre04, por un delito de INVASIÓN DE ÁREA PROTEGIDA Y TALA ILEGAL que se le venía atribuyendo como cometido en perjuicio de LOS RECURSOS NATURALES. Se declara sin lugar la acción civil resarcitoria incoada por la Procuraduría General de la República, resolviéndose sin especial condenatoria en costas.
Se ordena dejar sin efecto toda medida cautelar que hubiere sido dictada en contra del acusado, con ocasión del presente proceso penal. No existe evidencia sobre la cual se deba emitir un pronunciamiento. Se ordena un testimonio de piezas a fin de que se investigue si ha habido una invasión de área de protección con la construcción de una vivienda unifamiliar, a tenor del contenido del dictamen DCF:2015-04347-BIO. Mediante el dictado oral de esta sentencia, quedan todas las partes debidamente notificadas, pudiendo presentar recurso de apelación de sentencia ante el Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José. Alejandra Valenciano Chinchilla Jueza de Juicio. Jueza de juicio.” (sic, folios 381; el destacado es suplido).
II.Que, contra el anterior pronunciamiento, interpuso recurso de apelación el licenciado Enrique Montero Gamboa representante de la Procuraduría General de República.
III.Que, verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta la jueza Chinchilla Calderón; y,
CONSIDERANDO:
I.Resumen procesal y admisibilidad. (A) La sentencia impugnada fue emitida en un juicio de reenvío. Por ello, para verificar la competencia de reenvío, el que no haya operado la prescripción de la acción penal por prescripción y el respeto de los principios de imparcialidad del a quo y del ad quem, de respeto al doble conforme y de no transgresión del principio de prohibición de reforma en perjuicio, conviene hacer un breve recuento procesal de lo sucedido: i. Mediante sentencia 302-2021 de las 09:00 hrs. del 07 de mayo de 2021, el Tribunal Penal del Tercer Circuito Judicial de San José, sede Pavas, integrado unipersonalmente resolvió: “POR TANTO: De conformidad con los artículos 8 y 9 de la Convención Americana Sobre los Derechos Humanos, artículos 39 y 41 de la Constitución Política, artículos 209 y 216 del Código Penal, 1, 6, 9, 30 inciso e), 31, 33, 34, 142, 180, 311 inciso d) y 340 del Código Procesal Penal, se dicta SOBRESEIMIENTO DEFINITIVO POR EXTINCIÓN DE LA ACCIÓN PENAL en favor de Nombre04 por el delito de INFRACCIÓN A LA LEY FORESTAL que en perjuicio de EL PATRIMONIO FORESTAL se le venía atribuyendo.
Son las costas del proceso a cargo del Estado. NOTIFÍQUESE.” ii. El Procurador adjunto interpuso recurso de apelación y este tribunal, integrado por las juezas Quesada Salas y Corrales Pampillo y por el juez Gillen Bermúdez, mediante sentencia 2021-1066 de las 08:30 horas del 19 de julio de 2021 resolvió: “POR TANTO: Se declara con lugar el recurso de apelación interpuesto por la representación de la Procuraduría General de la República, se declara la ineficacia de la resolución venida en alzada y se ordena el reenvío al tribunal penal de origen para que con una integración diversa, valore lo correspondiente a partir de una correcta determinación de la estructura de los tipos penales en los que según la acusación se subsumen los hechos, y determinar si en el presente caso se está o no ante la causal de extinción alegada por la defensa. NOTIFÍQUESE.” iii. En el reenvío se dictó una absolutoria, que es la decisión aquí recurrida, tanto en lo penal como en lo civil dado que el Estado actúa en doble condición, como querellante y actor civil.
(B) El licenciado Enrique Montero Gamboa, abogado de la Procuraduría General de la República, interpuso recurso de apelación contra la sentencia dictada en autos, decisión que es impugnable por esta vía (taxatividad objetiva). Esta impugnación se planteó mediante escrito motivado aportado ante el órgano de instancia y dentro del plazo legal pues se entregó por fax el 18 de octubre de 2022 a las 03:23 pm (ver folio 384). Dado que la sentencia integral se emitió el 27 de setiembre de 2022 (ver folio 382), el plazo de 15 días hábiles no vencía sino hasta el 18 de octubre de 2022 y, por ello, en principio, el recurso sería admisible, dado que quien lo interpone está legitimado para ello (taxatividad subjetiva), sin que sean necesarias ulteriores formalidades pues, de lo contrario, se incumpliría el mandato establecido en el artículo 8.2.h de la Convención Americana sobre Derechos Humanos y lo resuelto por la Corte Interamericana de Derechos Humanos en el caso de Nombre05 contra Costa Rica, sentencia de 02 de julio de 2014.
No obstante, debe hacerse una consideración adicional: esta es la segunda sentencia sentencia exoneratoria de ambas responsabilidades (civil y penal) recurrida por el querellante, lo que obliga a externar unas consideraciones sobre el instituto del "doble conforme". En efecto, consta que en una primera sentencia se dictó el sobreseimiento del encartado y esta decisión fue recurrida por el representante estatal. Ante ello, por voto de este Tribunal (con diversa integración respecto de la actual) se acogió el recurso, se dispuso la nulidad de la sentencia y se ordenó el reenvío sobre tales aspectos. Ahora, el resultado es el mismo para los hechos penales que se enviaron al juicio de reenvío, absolutoria penal, y recurre solo la parte querellante. ¿Hay posibilidad de que el actor penal recurra doblemente la sentencia liberatoria de responsabilidad dictada en juicio? ¿Puede equipararse un sobreseimiento a una absolutoria para estos efectos?
Es menester hacer un recuento de lo sucedido en Costa Rica al respecto. Para determinarlo debe indicarse que, mediante la ley N° 8503 denominada de Apertura de la Casación Penal, vigente desde su publicación en la Gaceta número 108 del 6 de junio de 2006, se adicionó el artículo 451 bis al Código Procesal Penal. Ese numeral pasó a ser el 466 bis por la inclusión de una serie de artículos a través de la ley N° 8720 o Ley de Protección a Víctimas, testigos y demás sujetos intervinientes en el Proceso Penal y tenía el siguiente texto: “Artículo 466 bis.- Juicio de reenvío. El juicio de reenvío deberá ser celebrado por el mismo tribunal que dictó la sentencia, pero integrado por jueces distintos. El Ministerio Público, el querellante y el actor civil no podrán formular recurso de casación contra la sentencia que se produzca en el juicio de reenvío que reitere la absolución del imputado dispuesta en el primer juicio, pero sí podrán hacerlo en lo relativo a la acción civil, la restitución y las costas.
El recurso de casación que se interponga contra la sentencia del juicio de reenvío deberá ser conocido por el Tribunal de Casación respectivo, integrado por jueces distintos de los que se pronunciaron en la ocasión anterior. De no ser posible integrarlo con nuevos jueces, porque el impedimento cubre a titulares y suplentes, o no se cuenta con el número suficiente de suplentes, la competencia será asumida por los titulares que sean necesarios, no obstante la causal y sin responsabilidad disciplinaria respecto de ellos.” De acuerdo con esa norma, entre otras cosas, no era admisible el recurso de casación —única forma de impugnar una sentencia penal en ese momento— contra una sentencia que, por segunda vez, absolviera al imputado. El numeral 466 bis del Código Procesal Penal recogía el principio de la doble conformidad o única persecución que tiene como finalidad limitar la potestad punitiva del Estado, de manera que las personas no sean sometidas a procesos penales interminables, pasando una y otra vez por juicios hasta que se logre la sentencia condenatoria esperada.
A través de esa disposición se le garantizaba a toda persona sometida a proceso penal, que, si después de un segundo debate, es absuelto nuevamente, no deberá enfrentar un nuevo juicio, ya que esta segunda sentencia absolutoria no puede ser recurrida. Tal artículo fue derogado por el numeral 10 de la Ley de Creación del Recurso de Apelación de la Sentencia, otras Reformas al Régimen de Impugnación e Implementación de Nuevas Reglas de Oralidad en el Proceso Penal, N° 8837 de 3 de mayo de 2010. Sin embargo, fue restituido por la Sala Constitucional al acoger la acción de inconstitucionalidad número 12-007781-0007-CO, interpuesta contra la citada norma, resolviéndose, mediante voto N° 2014-13820 del 20 de agosto de 2014 a las 16:00 horas (vinculante erga omnes) que: “El Ministerio Público, el querellante y el actor civil no podrán formular recurso de casación contra la sentencia que se produzca en el juicio de reenvío que reitere la absolución del imputado dispuesta en el primer juicio, pero sí podrán hacerlo en lo relativo a la acción civil, la restitución y las costas”.
Allí se reconoció, de manera expresa, que dicho instituto es un instrumento que limita el poder punitivo del Estado y un derecho del acusado a ser juzgado en un plazo razonable, tutelando no sólo el derecho a justicia pronta y cumplida, sino el principio de progresividad. Si bien es cierto dicha norma, originalmente, operaba para efectos del recurso de casación, en criterio de esta cámara, una interpretación armónica implica comprender el contexto bajo la cual fue emitido, en el año 2006, ya que, en ese momento, el recurso de casación era el único medio para impugnar las sentencias penales. Con la creación del recurso de apelación en materia penal, es precisamente esta la vía ordinaria para impugnar la sentencia penal, por lo cual, aunque la norma haga referencia al recurso de casación, en el contexto actual de la normativa procesal penal, debe entenderse que su aplicación concreta es en relación con el recurso de apelación.
Pese a eso, posteriormente, la Sala Constitucional, por mayoría, mediante una aclaración de oficio a través de la sentencia N° 2014-17411, modificó el contenido de aquella sentencia número 2014-013820, con lo que prácticamente revocó su propio pronunciamiento (sin decirlo y sin que eso sea procedente) y delimitó la vigencia de este instituto únicamente al recurso de casación, con lo que resultaba imposible la aplicación de esa norma que está vigente por disposición de la misma Sala. Luego de ello, se formularon varias consultas judiciales de constitucionalidad tanto por este colegio jurisdiccional con una integración parcialmente similar a la actual (voto número 02-2016: Nombre06 y Nombre07) como por otros Tribunales de Apelación de Sentencia Penal del país (en materia de adultos y de personas menores de edad), oportunidades en que estos últimos órganos sostuvieron que ese cambio de criterio constitucional —por la vía de una adición y dejando incólume el voto inicial—: a) lesionaba el principio de seguridad jurídica, así como el derecho fundamental de todo ser humano a ser juzgado en un plazo razonable y a limitar la pretensión punitiva del Estado a medios y plazos razonables; b) No se adaptaba al actual régimen de impugnaciones, pues no es posible impugnar directamente con el recurso de casación, una sentencia del tribunal de juicio que absuelve en segunda ocasión al acusado dado que las sentencias de juicio se recurren con apelación y no hay de casación per saltum en ningún supuesto.
Al hacerse esas consultas judiciales de constitucionalidad se dijo que la Sala Constitucional no tomó en cuenta que, con la ley 8503 del 6 de junio de 2006, el régimen de impugnaciones era diferente y, contra las sentencias del tribunal de juicio, únicamente cabía el recurso de casación y, entonces, al cambiar el régimen de impugnaciones, para ser consecuente con lo que ya había resuelto con relación al instituto de doble conformidad, se debió indicar que el referido instituto debía ser interpretado como que no podría interponerse recurso de apelación contra la sentencia del tribunal de juicio que ha reiterado la absolutoria del imputado; c) desconocía el principio de progresividad, que impide que puedan desecharse de un ordenamiento jurídico, derechos ya conferidos que amplían el rango de las garantías en tutela de los derechos fundamentales consagrados en la Constitución Política o en las Convenciones sobre Derechos Humanos, todo lo cual también había sido reconocido en la sentencia de mayoría número 2014-013820 de la Sala Constitucional.
Empero, dichas consultas fueron declaradas, en su mayoría, inadmisibles por el órgano constitucional (ver votos números 2015-9884, 2015-9886, 2015-9965, 2016-1210, 20126-2380, 2016-3477, 2016-4919 y 2017-16725) y otras se supeditaron a otras decisiones (ver votos números 2016-9452 y 2016-9453). Concomitantemente, se interpuso una acción de inconstitucionalidad que fue resuelta a través de la sentencia número 16967-16 de las 10:42 horas del 16 de noviembre de 2016, en donde, por mayoría, se declaró sin lugar y se indicó: “Esta Sala ya se pronunció, mediante las resoluciones 2014-013820 y 2014-017411, en el sentido que la restitución del artículo 466 bis del Código Procesal Penal se refiere sólo se refiere al recurso de casación y lo allí previsto no puede extenderse al recurso de apelación.” Más adelante, a través del voto número 2018-007208 del 09 de mayo de 2018 el órgano constitucional reafirmó: “Se evacua la consulta en el sentido que la restitución del artículo 466 bis del Código Procesal Penal se refiere sólo al recurso de casación y lo allí previsto no puede extenderse al recurso de apelación.
Los Magistrados Castillo Víquez y Rueda Leal dan razones adicionales. La Magistrada Hernández López y el Magistrado Hernández Gutiérrez salvan el voto y disponen evacuar la consulta planteada señalando que el artículo 466 bis del Código Procesal Penal no es inconstitucional siempre y cuando se entienda que la única interpretación conforme con el derecho de la Constitución es la de estimar que contra la segunda sentencia absolutoria penal, no se puede interponer recurso alguno sobre lo resuelto en torno a la responsabilidad penal.” (Se suplen los destacados). Aunque esta cámara, por unanimidad, estimaba que el voto de mayoría de la Sala Constitucional no se ajustaba a derecho (porque desconocía el principio de progresividad de los derechos humanos, al hacer más gravosa la situación de la persona doblemente absuelta en fase de juicio; porque afectó el principio de seguridad jurídica derivado del cambio del sistema impugnativo y porque, por la vía de aclaración, no era factible modificar un voto de fondo) no podía apartarse de él, en tanto había sido reiterado, ya en forma expresa y clara, por esa mayoría de la magistratura constitucional y no había un parámetro de superior rango (convencional) al que hacer referencia, razón por la que, en atención a lo dispuesto por el artículo 13 de la Ley de la Jurisdicción Constitucional, debía aplicarse dicho precedente y dársele la admisibilidad respectiva al recurso.
Mientras eso sucedía, la Sala Tercera (por voto número 2019-62) declaró sin lugar las casaciones interpuestas contra rechazos de recursos de apelación que, en criterio de otras secciones o tribunales de apelación de sentencia penal, sí resultaban improcedentes. Concomitante en la Asamblea Legislativa constaban dos proyectos de ley (expedientes legislativos números 19906 y 19908) que pretendían reformar el citado instituto para darle los alcances que tenía originalmente y cumplir, de ese modo, lo indicado en los votos constitucionales sobre la reserva de ley. Por último, mediante ley 10200 del 05 de mayo de 2022 que rige a partir de su publicación la cual se produjo en La Gaceta No. 100 del 31 de mayo de 2022 (es decir, anterior a la fecha de emisión de esta sentencia) se aprobó una reforma al numeral 466 bis del Código procesal penal para que se lea de la siguiente forma: “Artículo 466 bis- Juicio de reenvío.
El juicio de reenvío deberá ser celebrado por el mismo tribunal que dictó la sentencia, pero integrado por jueces distintos.//El Ministerio Público, el querellante y el actor civil no podrán formular recurso de apelación contra la sentencia del Tribunal de Juicio que se produzca en juicio de reenvío que reitere la absolución de la persona imputada dispuesta en un juicio anterior.//En el caso del párrafo anterior, sí se podrán interponer los recursos correspondientes en lo relativo a la acción civil resarcitoria, la restitución y las costas.” (El destacado se suple). En consecuencia, el recurso presentado solo puede ser admitido para análisis en cuanto a temas civiles, de restitución y costas (si esto fuese lo alegado) pues la exoneración penal de responsabilidad está firme al ser inadmisible su cuestionamiento ya que, si bien en la ocasión anterior a la resolución se le denominó “sobreseimiento” y no absolutoria, ambas decisiones tienen los mismos efectos y se emitieron en fase de juicio.
Finalmente, sobre la aplicación del doble conforme a la materia civil, ha señalado esta cámara, con idéntica integración, lo siguiente: “Del artículo 466 bis antes reproducido se extrae que si bien la parte actora civil tampoco puede formular apelación contra la sentencia absolutoria producida en el reenvío que reitere la absolución de la persona acusada dispuesta en un juicio anterior, el recurso sí procede en lo relativo a “la acción civil resarcitoria, restitución y costas” (el destacado no es del original). Es decir, si bien en relación con lo decidido en el ámbito penal no cabe interponer apelación, tratándose de lo civil la situación es distinta. Conviene hacer notar que el propio código contempla, al abordar el tema de la acción civil resarcitoria, la distinción que corresponde hacer entre la “sentencia absolutoria” y el pronunciamiento que se haga sobre la acción civil válidamente ejercida, cuando así proceda (así, cfr. por ejemplo, artículo 40 del C.P.P.), lo que es comprensible si se toma en cuenta que los presupuestos de la responsabilidad civil son diferentes a los de la penal.
Como señala el profesor Llobet Rodríguez, “Fundamental con respecto a la responsabilidad civil es la existencia de un daño, que deba ser asumido por una persona física o jurídica, con base en un título de imputación, que lo obliga a asumir la reparación del daño. Debe tenerse en cuenta que la responsabilidad penal se rige por el principio de culpabilidad, requiriéndose que la conducta realizada sea típica, antijurídica y culpable. Ello no se exige en la responsabilidad civil, la que establece incluso diversos supuestos de responsabilidad civil objetiva. Por ello puede existir responsabilidad civil, aunque no exista la penal” (Llobet Rodríguez, Javier. Proceso Penal Comentado. Código Procesal Penal Comentado. San José: Editorial Jurídica Continental, 6° edición, 2017, p. 152). Esta cita permite comprender por qué se concluye que el término absolutoria está referido, para efectos del artículo 466 bis mencionado, a una decisión que se adopta con respecto a la acción penal y no sobre lo civil.
Asimismo, en tanto que la parte actora civil no puede recurrir la primera (sentencia absolutoria) cuando reitera una absolutoria anterior dictada en juicio, sí puede apelar, en lo que aquí interesa, lo dispuesto sobre su demanda civil.” (Resolución 2022-0882 de las 07:40 horas del 20 de junio de 2022). (C) Sobre los requisitos para la restitución. Aunque, como se verá, esta cámara coincide en que, en este asunto, el recurso es procedente, hay discrepancia en torno a los argumentos y requisitos para ello. (C.1) Posición de mayoría (juezas Chinchilla y Jiménez). Es importante tener en cuenta que la restitución de cosas al estado original no es una simple medida provisional penal (como sí sucede con el restablecimiento de las cosas al estado anterior estipulado en el numeral 140 del Código Procesal Penal) sino que forma parte de las pretensiones civiles que, en este caso, fueron ejercidas por la parte recurrente, quien es actora civil y se ordenan en la sentencia final (no durante la fase de investigación).
En estos términos se indicó en el voto número 2016-633 (Nombre08, R. Chinchilla y Nombre09) en el que se dijo que el sustento jurídico de este extremo se encuentra en el artículo 103 del Código Penal, el cual, en lo que interesa, indica: "Todo hecho punible tiene como consecuencia la reparación civil, que será determinada en sentencia condenatoria; ésta ordenará:1) La restitución de las cosas o en su defecto el pago del respectivo valor (...)". Esta disposición debe ser contextualizada, con el fin de obtener una interpretación ajustada a lo que el legislador pretendió con ella. Su ubicación en el Código Penal, en el Título VII denominado "Consecuencias Civiles del Hecho Punible", implica que tiene relación directa con el reclamo civil pretendido por la víctima de un hecho punible. Además, los tres incisos se sujetan a la determinación de "reparación civil" en sentencia (sobre el comiso, existe gran discusión en doctrina acerca de si es o no una consecuencia civil del hecho, no obstante, al no ser este el tema impugnado, esta cámara no va a entrar a discutir este punto).
En relación con lo anterior, el numeral 122 de las Reglas Vigentes sobre Responsabilidad Civil, aclara que este tipo de reparación comprende "1° La restitución de la cosa", lo que confirma que, efectivamente, cuando se alude a este extremo, debe considerarse una consecuencia civil del hecho. Ahora bien, el artículo 103 citado ordena que, en sentencia condenatoria (se entiende en lo civil pues hay independencia entre esa responsabilidad y la penal: artículo 40, in fine, del Código Procesal Penal), el tribunal deba pronunciarse en cuanto a la restitución de las cosas (y el numeral 491 del Código Procesal Penal reafirma el carácter indemnizatorio civil al decir que si hay controversia se remite a las personas interesadas a la vía civil). Con base en todo lo anterior se concluye que la restitución de las cosas a su estado anterior es parte de lo que puede disponerse cuando existe condenatoria civil (esto debe diferenciarse de la simple restitución de la cosa, que se ordena en sentencia cuando el objeto del delito deba ser devuelto a su legítimo dueño o poseedor, y que, generalmente, se encuentra en depósito provisional).
Empero, la pregunta que se asoma de inmediato es si el tribunal puede condenar civilmente al imputado sin que exista petición de una de las partes (de oficio). De acuerdo con el artículo 368 del Código Procesal Penal, para que se emita una resolución que condene en lo civil, se requiere, obligatoriamente, que se haya ejercido la acción civil resarcitoria conforme con los artículos 37 a 41 de este mismo cuerpo legal. Asimismo, el numeral 111 del Código de rito señala: "Para ejercer la acción resarcitoria, su titular deberá constituirse en actor civil (...)". La demanda que contiene las pretensiones de reparación o de restitución de las cosas a su estado anterior, debe cumplir con una serie de requisitos, entre los que se encuentra, según el artículo 112 del Código en mención: "d) Los motivos en que la acción se basa, con indicación del carácter que se invoca y el daño cuya reparación se pretenda, aunque no se precise el monto".
Estas pretensiones deben concretarse, conforme con el artículo 308 del Código Procesal Penal, al decirse: "Cuando se haya ejercido la acción civil resarcitoria, el Ministerio Público también deberá poner la acusación en conocimiento del actor civil, para que dentro del plazo de cinco días concrete sus pretensiones, indique la clase y forma de reparación que demanda y liquide el monto de daños y perjuicios que estime haber sufrido hasta ese momento (...)". De conformidad con eso, la audiencia que se confiere tiene como fin que el actor civil defina cuáles son sus intereses concretos, de acuerdo con lo solicitado en la demanda planteada, lo que debe incluir, por supuesto, la restitución, si es de su interés. Por ende, resulta imposible considerar que el reclamo dirigido a restituir las cosas a su estado anterior pueda hacerse de oficio, pues los extremos civiles deben declararse a partir de lo solicitado en la demanda respectiva.
En este caso, sí hubo acción civil resarcitoria por lo que por esta razón más lo que se agregará procede conocer la queja. (C.2) Posición de la jueza Vargas González. Tal y como señalé en el voto salvado contenido en la resolución 2021-0921 de las 8:35 horas del 23 de junio de 2021, dictado por esta cámara, con una integración similar (R. Chinchilla Calderón, L. Murillo Mora y P. Vargas González) «[…] la restitución de las cosas a su estado original no es una consecuencia civil derivada del hecho punible, sino una sui generis que debe disponerse de oficio, entiéndase, al margen de que haya una sentencia condenatoria o incluso una acción civil resarcitoria, lo anterior con base en el numeral 366 del Código Procesal Penal. Al respecto ha apuntado esta cámara, con una integración similar a la actual (Nombre10, Vargas González y Murillo Mora) lo siguiente: “El cuestionamiento que plantea la abogada defensora, al argumentar que la restitución no puede disponerse cuando se absuelve penalmente al imputado y cuando no se ha ejercido la acción civil resarcitoria, no resulta novedoso, siendo que este tribunal de apelación ya ha tenido la oportunidad de pronunciarse al respecto y no comparte tal posición.
Así, con fundamento en lo que dispone de manera expresa el artículo 366 del Código Procesal Penal (que es una norma posterior al artículo 103 del Código Penal, que la impugnante cita en apoyo de su tesis), la jurisprudencia ha interpretado que aún en el supuesto de que se trate de un fallo absolutorio en cuanto a los extremos penales, el juzgador sí está facultado para ordenar ‒incluso de oficio‒ la restitución de los objetos afectados al procedimiento: “[…] Existe un error en el fallo en cuanto al fundamento jurídico para ordenar el desalojo, pues la norma que autoriza esa medida no es el artículo 142 del Código Procesal Penal, sino el 366 ibídem. En esta se regula en forma expresa “La sentencia absolutoria ordenará...la restitución de los objetos afectados al procedimiento que no estén sujeto al comiso...”. En el caso en concreto el Tribunal tuvo por demostrado que el terreno ocupado por los imputados pertenece al Estado y es utilizado por el Ministerio del Ambiente y Energía, como parte del Proyecto de Ordenamiento Territorial Zona Núcleo del Refugio de Vida Silvestre Barra del Colorado.
Sobre estos no puede alegarse la simple posesión o bien el derecho de posesión, en el tanto están fuera del comercio y resultan imprescriptibles (art. 262 del Código Civil y Sentencia 733-F-00, de las 15:12 horas del 4 de octubre del 2000, de la Sala Primera de la Corte Suprema de Justicia). Acreditada la pertenencia del predio y su destino a la preservación de la naturaleza, la consecuencia jurídica era la expulsión de los ocupantes, conforme se decretó en el fallo […]” (cfr. Tribunal de Casación del Segundo Circuito Judicial de San José, voto N° 2004-00933 de las 11:00 horas del 09 de setiembre de 2004). En el mismo sentido, siempre con base en lo dispuesto por el artículo 366 del Código Procesal Penal, se estimado la procedencia de la restitución de cosas al estado anterior aún en caso del dictado de una absolutoria, cuando se esté ante una infracción a la zona marítimo terrestre (cfr.
Tribunal de Casación del Segundo Circuito Judicial de San José, votos 2004-0919 y 2004-0933). Incluso, se ha optado por esta solución aún en el supuesto de una sentencia absolutoria por el delito de usurpación: “[...] si según los hechos probados, la aquí acusada se encuentra ocupando un predio que era poseído por otra persona, lo consecuente es ordenar la restitución en la misma sentencia, con el fin de no retardar innecesariamente el regreso de la ofendida al inmueble. Al respecto, en un fallo de 1992, nuestra Sala de Casación indicó, para un caso en que se comprobó el hecho de usurpación, lo siguiente: “Debe admitirse que lo óptimo es que, en casos como el presente, la restitución de la posesión se ordene en la misma sentencia que condena por el delito de usurpación, a efecto de no retardar innecesariamente el regreso del ofendido al poder de hecho por el cual sometía a su control y voluntad el inmueble usurpado, sin embargo, si tal disposición se omite en la sentencia, nada impide que con posterioridad a ella se dicte una resolución que -en ejecución de aquella condena- venga a ordenar el desalojo del inmueble por parte del usurpador para que el ofendido entre en su posesión, como sucedió en el caso en examen.
No sobra decir que tal solución es no solo la que deriva de la correcta aplicación y entendimiento de la ley, sino que además es la que imponen las normas más elementales del sentido común: resultaría absurdo que el imputado, amparándose a la sentencia que le condena por el delito de Usurpación, legitimara y mantuviese la posesión del mismo inmueble a que accedió en forma típica, antijurídica y culpable”. Sala Tercera de la Corte Suprema De Justicia, V-107-F, de las ocho horas cincuenta y cinco minutos del tres de abril de mil novecientos noventa y dos.- Este fallo es aplicable al subjúdice, no sólo porque advierte la necesidad de no mantener un sinsentido jurídico, el cual se daría al absolver a alguien por la usurpación, porque ostentaba una falsa creencia sobre su mejor derecho de poseer el bien y de obtener su adjudicación legal, y luego mantenerlo en la posesión hasta tanto se demuestre el mejor derecho de posesión de la ofendida, quien adquirió, con las dificultades probatorias y negociales que pudieran existir, el derecho a poseer ese bien.
La prueba habida, así como las consideraciones técnicas y jurídicas que hace el defensor, hacen prevalecer el criterio de la juzgadora de mérito y de este Tribunal, que en este caso debe ordenarse el abandono del predio, y que si la señora Nombre11.Nombre12. considera que su derecho debe prevalecer, así habrá de plantearlo en otra sede, civil o agraria, según sea la naturaleza del fundo y de su dedicación. De acuerdo con lo antes expuesto, se tiene que la orden de restitución del inmueble a favor de la señora Nombre13. ni siquiera podría interpretarse como una sanción (ni penal ni civil), sino más bien como una consecuencia natural y lógica, derivada de la prueba evacuada en el juicio [...] Así las cosas, no obstante la absolutoria dictada en cuanto a la imputación penal, el juez de mérito estaba obligado a ordenar que la titular del bien en litigio fuese puesta en posesión del mismo, por tener un mejor derecho de posesión.
Al respecto se tiene que en la generalidad de los casos el bien en discusión se encuentra en poder del acusado absuelto, por lo cual si se llegara a acreditar que la titularidad sobre el mismo corresponde a un tercero (como sucedió en la especie), debe restituírsele a éste. […] El artículo 366 párrafo 1º del Código Procesal Penal establece que la sentencia, aún siendo absolutoria, ordenará la restitución de los objetos que estén afectados al procedimiento y que no estén sujetos a comiso, sin que precise que esa restitución deba hacerse en favor de un sujeto determinado. Ello implica, entonces, que a dichos efectos el juzgador deberá determinar cuál es la persona que tiene mejor derecho sobre el objeto, aún y cuando se trate de un tercero. Si bien podría interpretarse que esta norma no se refiere a bienes inmuebles sino más bien a simples "objetos" (muebles), tal tesis debe rechazarse, no sólo porque el comiso también es aplicable a propiedades (artículo 465 del Código Procesal Penal), sino además porque el numeral 140 ibidem establece que en cualquier estado del proceso y a solicitud del ofendido, el juez podrá ordenar, como medida provisional, el restablecimiento de las cosas al estado en que se encontraban antes del hecho.
Si el juzgador ostenta esta potestad como medida provisional, con mucha más razón puede decretarla como restitución definitiva al dictar la sentencia de fondo, donde que se haya determinado la titularidad del bien que ostenta determinada persona. Por otra parte, debe reiterarse que la orden de restitución del inmueble a favor de la señora Nombre13. ni siquiera podría interpretarse como una sanción (ni penal ni civil), sino más bien como una consecuencia natural y lógica, derivada de la prueba evacuada en el juicio, a partir de la cual se logró acreditar que ella lo adquirió en 1999 y desde entonces ha venido ejerciendo la posesión sobre el mismo. Al respecto se comprende que el artículo 366 párrafo 1º ya comentado, donde se le exige al juez que emita el respecto pronunciamiento en cuanto a este extremo, determina que esa decisión es oficiosa, pues a efectos de ordenar la restitución no se requiere que, como condición previa, la parte ofendida haya ejercido la acción civil resarcitoria, ni tampoco que en cuanto a ello haya formulado una pretensión directa y expresa.
El hecho de que aún y cuando no haga falta hacerlo, la parte ofendida plantee dicha demanda (con lo cual podría obtenerse por dicha vía una "condena" a restituir, según lo dispone el artículo 464 del Código Procesal Penal), de ningún modo implica que la acción civil era necesaria. Por lo expuesto, sin lugar el recurso […]” (cfr. voto del Tribunal de Casación Penal del Segundo Circuito Judicial de San José N° 2006-1115 de las 09:18 horas del 20 de octubre de 2016, que a su vez cita y se apoya en el voto de la Sala Tercera de la Corte Suprema de Justicia N° 107-F-92 de las 08:55 horas del 03 de abril de 1992). En este mismo sentido, es decir, que la restitución procede aunque no se haya ejercido acción civil resarcitoria, también pueden consultarse los votos de la Sala Tercera N° 1462-2004 y N° 604-F-91. Teniendo en cuenta lo anterior, se debe precisar que, obviamente, la orden de restitución podrá disponerse siempre que dicha medida sea materialmente posible, lo cual por ejemplo sucederá cuando, tratándose de un bien mueble, el mismo esté en poder del despacho judicial (cfr. hipótesis regulada por el artículo 367 del Código Procesal Penal).
De igual modo, tratándose de bienes inmuebles la restitución (de proceder) siempre será factible, en la medida en que la autoridad jurisdiccional podrá apersonarse al terreno respectivo y mediante un acto formal lo dejará en posesión de la persona legitimada para ello. Es claro que tal opción no sería posible en casos en los cuales se trate de bienes muebles que, al no estar secuestrados o entrados en depósito provisional, no se sepa dónde se hallan o si todavía existen, siendo en tal supuesto que, como medida subsidiaria, lo que corresponderá será una reparación económica mediante la condena al pago de daños y perjuicios […]” (Resolución N° 2018-0095, dictada a las 9:44 horas del 30 de enero de 2018, el destacado es suplido). Por lo expuesto, se concluye que la restitución del área de protección a su estado original no está supeditada a la condena de la persona acusada. Además —contrario a lo que señala la sentencia recurrida— el que por años algunos hayan invadido impunemente las áreas de protección señaladas por el legislador y que las autoridades municipales y estatales hayan tolerado esta situación en lugar de cumplir con sus deberes no cambia que los órganos jurisdiccionales, cuando así proceda, están obligados a disponer esa restitución, pues el derecho a un ambiente sano y ecológicamente equilibrado es un derecho fundamental de quienes habitan este país y el Estado debe garantizar y defender el mismo.» Como apunté entonces, considero que la restitución de las cosas a su estado original, dada su naturaleza sui generis, puede disponerse a pesar de que no exista una condena en lo penal, o de que no se haya ejercido la acción civil resarcitoria.
Salvo en este punto, sobre el cual las demás integrantes de este tribunal tienen una posición distinta, coincido con ellas en cuanto que la decisión adoptada por el a quo carece de fundamentación y por ello, debe ser anulada. (C.3) No obstante, ya sea partiendo de la posición de mayoría o de la minoritaria, en este caso sí se ejerció la acción civil por la apelante, por lo que tal controversia no incide en el caso específico.
II.En el único motivo del recurso, el procurador alega que la sentencia inaplica el numeral 50 de la Constitución Política pues no ordena la restitución de las cosas a su estado anterior pese a que se demostró el grave daño al ambiente y se delimitó el lugar en donde ello sucedió. Señala que en el considerando IV (minutero 15:37) se alude al movimiento de tierra de un camino realizado en el inmueble y la tala de cuatro árboles de especies varias dentro del área de protección de dos nacientes, una naciente de carácter permanente, pese a lo cual “no se determina la responsabilidad penal ni civil de los hechos” pues no se acreditó que los trabajos fueran ordenados por el encartado. Según quien impugna, en el minuto 28:38 se indica que no se puede hacer la restitución pues los árboles fueron talados y construido el camino, sin dar mayores detalles. Indica el recurrente que tal restitución deriva del numeral 41 constitucional y del numeral 103 del código punitivo.
Alude a la sentencia 52-F-1990 y 2022-437 de la Sala Tercera como sustento para hablar de una responsabilidad objetiva civil en materia ambiental. Añade que la decisión es omisa y entra en contradicciones pues, pese a tener por acreditado el daño, indica que tal restitución no puede operar, pero sin fundamentar más allá. Pide que se ordene tal restitución en forma directa o, subsidiariamente, se anule la sentencia en cuanto al no pronunciamiento sobre tal tema y se ordene el reenvío. No consta pronunciamiento de la contraparte. El recurso, por unanimidad, debe acogerse. En el presente asunto, la parte impugnante concentró su alegato en el rechazo de ordenar la restitución de las cosas a su estado anterior, por lo que el recurso se ubica en los límites de admisibilidad ya referidos atrás. El tribunal declaró sin lugar la acción civil y la restitución pedida pese a que, como bien indica la parte recurrente, a partir del minuto 28:38 se acepta que hubo un daño ambiental (árboles fueron talados y camino construido en áreas de protección) y, sin mayor argumentación, se alude a la imposibilidad de restituir las cosas al estado anterior dándose a entender (porque tampoco se dice expresamente) que como ya el camino estaba construido o los árboles talados, era imposible impedir tal cosa pero sin analizar otras posibilidades como la reversión de aquella obra o la plantación de especies similares.
Esa omisión de motivación afecta la validez de la sentencia, tal y como lo estipula el numeral 142 del Código Procesal Penal, pues el derecho al acceso a la justicia contenido en el artículo 41 de la Constitución Política exige que se haga pronunciamiento ampliamente fundamentado sobre la totalidad de las peticiones de las partes y la que aquí se discute deriva de una responsabilidad objetiva estatuida tanto constitucional como legalmente, en protección al derecho al ambiente, lo que tampoco fue examinado. En consecuencia, lo procedente es, en cuanto al extremo omitido, específicamente las pretensiones civiles de la Procuraduría General de la República, ordenar el juicio de reenvío para que sea sustanciado y resuelto como en derecho corresponde. En lo demás, permanece incólume la sentencia.
POR TANTO:
Se declara con lugar el recurso de apelación interpuesto por el licenciado Enrique Montero Gamboa representante de la Procuraduría General de República. Se anula parcialmente la sentencia impugnada, solo en cuanto deniega la restitución de las cosas a su estado anterior y, sobre tal aspecto, se ordena el reenvío ante una integración nueva del órgano de instancia. En lo demás, la sentencia permanece firme. NOTIFÍQUESE.
