San Ramón, at thirteen hours fifty-five minutes on veintinueve de noviembre de dos mil veintidós.
APPEAL OF JUDGMENT (RECURSO DE APELACIÓN DE SENTENCIA) filed in the present proceedings against [Nombre1], a Costa Rican national, holder of identity card number CED1, for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of NATURAL RESOURCES. Judges José Alberto Rojas Chacón, Yadira Godínez Segura, and Karina Redondo Gómez participated in deciding the appeal. Appearing in the appeal proceedings are attorney Arturo Figueroa García, as representative of the Ministerio Público; State Criminal Attorney Randall Aguirre Mena; and attorney Jeannette Salazar Araya, as legal representative of the private complainant (querellante) and civil plaintiff (actora civil), Ms. [Nombre2].
BACKGROUND:
Appellate Judge Rojas Chacón authors the decision; and,
CONSIDERING:
I.As the sole ground of the appeal against the judgment filed by the representative of the Ministerio Público, the appellant alleges contradictory reasoning, violation of the rules of sound judicial reasoning (reglas de la sana crítica), and disagreement with the assessment of the evidence. The appellant criticizes the Trial Court for conducting a selective and erroneous analysis of the evidence because, without assessing the technical opinions received in their entirety, it found doubt as to the defendant’s understanding of the requirements of the criminal offense (tipo penal) established in Article 58 of the Ley Forestal and as to whether the water source was a spring (naciente), since the judges considered it necessary to establish the existence of an aquifer (acuífero) in the area. This was so even though the hydrogeological expert, [Nombre4], explained at trial why there was a spring in the area and why the protection area (área de protección) had been encroached upon.
The lower court (A quo) instead adopted an untenable argument, stating that the FUNDEVI study used to establish the existence of the spring indicated a discrepancy regarding the depth of the water at the site relative to sea level and noting that no drilling had been performed. The judges, however, disregarded the opinions of several professional geologists and technical experts in the field, who clearly stated that the characteristics of the fractures in the rocks, the topographic conditions, and the existence of wells in the area established the presence of aquifers, and that the body of water had historically been a spring giving rise to quebrada Flores, which begins at the spring and receives no contribution other than groundwater. That spring maintains its flow throughout the year and is permanent, as [Nombre4] and [Nombre5] testified. After quoting an excerpt from the judgment, the appellant criticizes the trial court for failing to analyze the fact that, beginning with the permit application, the defendant was given clear information about the existence of springs in the area and the requirement to respect the protection area.
Nevertheless, in violation of sound judicial reasoning, the lower court reasoned that, even though the defendant was the party interested in the project, any other person could have received all the documents being added to the construction file and that, because an engineer was in charge of the project, the accused had no reason to be aware of those documents. The appellant, however, considers the judgment’s analysis incomplete, since it was established that the project was shut down in the defendant’s presence, that SINAC personnel were present for that purpose during the inspection of November 18, 2019, and that, despite the shutdown following the inspection—when he was already clearly aware of the spring’s existence—he continued the work encroaching upon the site. The appellant criticizes the judgment for purporting to find that, despite the foregoing, the defendant did not know he was violating the law.
The appellant considers the judgment devoid of reasoning on this point because, according to the evidence received and ordinary human understanding, under those circumstances the defendant should have consulted sources that could already have clearly established the existence of the spring upon which the completed construction was encroaching. The judgment also disregarded the fact that, since 2007, documentation related to the construction had informed him of the existence of the protection area at the site (file of the Municipalidad de Grecia). After citing other excerpts from the judgment, the appellant alleges that the evidentiary analysis was biased and that the Trial Court’s requirements exceeded the technical opinions received at trial, because it disregarded the testimony of geologist [Nombre4] [Nombre4] and the most recent expert reports issued by the Dirección de Aguas, which established the existence of a spring in the area.
The appellant alleges that the Trial Court departed from the principle of freedom of proof (principio de libertad probatoria), since the spring’s existence could be demonstrated through any suitable means of evidence; instead, it reopened the trial without justification to obtain an opinion from the Departamento de Aguas. Although that opinion established the existence of the spring in the area, it was insufficient for the sentencing court, which asserted that doubt arose from the nomenclature used to locate the spring and from the location of the points under study identified as springs. In doing so, it disregarded the fact that, notwithstanding the nomenclature and coordinates used, all of them established a greater or lesser encroachment upon the protection area, a circumstance that did not affect proof of an encroachment in this particular case. Indeed, the GEOTEC report prepared by [Nombre6] establishes the existence of spring 257, which gives rise to quebrada Flores and is located at [Dirección1] on the property, and the encroachment was established through this expert’s testimony.
The appellant alleges that the defendant’s subsequent conduct was not analyzed and that the judgment likewise fails to explain why restoration to the prior condition (reestablecimiento de las cosas al estado anterior) was not ordered, thereby violating the pro natura principle (principio pro natura). The appellant requests that the challenged judgment be vacated and that the case be remanded for further proceedings concerning the Violation of the Ley Forestal. As the first ground of the appeal filed by the Procuraduría General de la República, in its capacity as private prosecutor (querellante) and civil claimant (actor civil), it alleges insufficient substantive reasoning (falta de fundamentación intelectiva) and an erroneous assessment of the evidence, in violation of the principle of freedom of proof, with respect to the acquittal of [Nombre7] of the offense of Violation of the Ley Forestal and the denial of the civil claim for damages (acción civil resarcitoria).
It states that the defendant was charged with encroaching upon the protection area of springs 257 and 258, despite having been warned by the Municipalidad de Grecia of their existence and of the duty to construct outside the 100-meter radius, but nevertheless erected the building within that area. It notes that the Trial Court based the acquittal on doubt regarding the characterization of the body of water at the site, as well as doubt regarding its location. It raises several objections to this: a) Regarding the doubt as to the existence of groundwater near the surface, which affects the determination of whether there is a spring on the defendant’s property. After quoting an excerpt from the grounds of the judgment, the appellant criticizes the Trial Court for unjustifiably characterizing as empirical the technical reports issued by reputable institutions such as [Nombre8] and the Dirección de Aguas.
Those studies were admitted for the purpose of partially validating the opinion of geologist [Nombre6] [Nombre6], which had been submitted by the defense, and then using it to support the existence of doubt. The appellant notes that, according to the Trial Court, an on-site inspection was insufficient; rather, an analysis had to be performed to establish the water table (nivel freático) at the site and, on that basis, determine whether groundwater surfaced (afloramiento). The appellant states that this argument is based essentially on a FUNDEVI and Universidad de Costa Rica study prepared in 2007—which was not introduced into the adversarial proceedings (contradictorio)—and cited only by [Nombre8] in official communication DIGH-UGH-OF-086-2012 as a general reference concerning the location of aquifers. The study was later challenged by the defense expert using precisely the assertion that the water table at the site lies at 70 meters.
However, the appellant continues, the Trial Court failed to assess and analyze a series of evidentiary elements explaining why the water table at the site was near the surface rather than at 70 meters, and why it was even less necessary to determine the depth of the wells in order to establish this issue. The appellant criticizes the judges for merely citing the GEOTEC report issued by [Nombre6], which does not even contain a substantive analysis of the water table. It is noteworthy that the report was not examined by the Trial Court, which instead relied on statements made by that geologist during the adversarial proceedings, even though the GEOTEC report contains a series of statements indicating that water emerges at the site, yet contradictorily concludes that what exists there is a stream. The appellant notes that the Trial Court asserted that a groundwater study was required because a FUNDEVI and UCR study issued in 2007 established that, across a broad geographic area—not at the specific location of the events—the water table was at 70 meters, from which it inferred that no groundwater surfaced.
The judges, however, failed to consider that the GEOTEC report establishes that water emerges at the site, that there is a group of springs, and even that a small flow of approximately 0.5 liters per second surfaces there. The appellant questions how this could be possible if the water table were at 70 meters, which is illogical. Nevertheless, the judges stated that an analysis of the water table was necessary because a 2007 study indicated that it was at 70 meters in a geographic area, an argument inconsistent with the inferences arising from the evidence and the on-site findings recorded in the 2010 GEOTEC report. Furthermore, the appellant alleges that the Trial Court failed to consider that [Nombre8] report DIGH-UGH-OF-086-2012 provides a technical explanation of why a spring did exist at the site. Because this evidence was not assessed, the argument that there was no technical explanation of why groundwater reached the surface at the site—and thus that the water table was near the surface and a spring existed—is untenable.
The appellant considers that the Trial Court proceeded from false premises by treating as empirical the technical reports explaining why the water table was near the surface, and thus why the study the judges found lacking was unnecessary, as well as by appealing to authority to suggest that [Nombre8] must be believed solely because it is [Nombre8] and that its characterization of a spring must be accepted. The appellant also criticizes the failure to analyze the testimony of geologist Rafael Matamoros, who stated that during his visit to the site he found fractured rock, which is possible only when groundwater surfaces, and that a large quantity of water must emerge at the surface for a stream to originate. This was determined on the basis of the inspection conducted at the site by the [Nombre8] geologist and follows from the statements contained in the GEOTEC report. None of this was analyzed; instead, the 2007 study was given precedence.
The appellant questions the Trial Court’s failure to consider the defense expert’s own statements regarding the emergence of water and his assertion that this was explained by the presence of wastewater (aguas servidas) causing water to reach the surface, even though official communication DA-UHTPCOSR-240-2019 from the Dirección de Aguas, brought into the proceedings and admitted by the Trial Court itself, states that there is no stormwater (aguas pluviales) at the site and that the flow begins at a fracture in the rock face and remains at the same point during both the dry and rainy seasons, that this is a spring, and that quebrada Flores originates there. Consequently, according to the Dirección de Aguas, it is indeed a spring because groundwater surfaces there. The appellant questions the accommodating conduct of expert [Nombre6] and states that this is not the first time he has maintained in criminal proceedings that a stream exists where there is a spring, while the judgment contains no ruling on the challenges that the Procuraduría raised against this expert in its closing arguments (conclusiones).
The appellant adds that the Municipalidad’s file contains a sworn statement (declaración jurada) by Engineer [Nombre9] Alfaro ruling out any discharge of wastewater on the property, contrary to the assertion of expert [Nombre6].
The appellant lists a series of reports and official communications admitted into evidence that, in his view, conclusively establish the permanent nature of the spring (naciente) constituting the body of water located on the property, and criticizes the Court for having questioned its existence because no groundwater-depth studies were conducted, alleging that this evidence was assessed in a fragmented and incomplete manner. b) Regarding the existence of doubt as to the spring’s location: After transcribing an excerpt from the grounds of the judgment, he states that the acts attributed to Mr. [Nombre1] are that, despite having been warned by the Municipality of the existence of two uncaptured water springs, designated 257 and 258, within his property, and that construction had to take place outside the 100-meter protection area (área de protección), he disregarded the warning and built his home; therefore, the issue to be proved (thema probandum) in the proceedings is limited to determining whether that building was erected within the protection area of those springs.
He states that official communication PUSS-US-707-208 (municipal case file), addressed to the accused, warns of the existence of two uncaptured springs within his property and that development must take place outside the 100-meter radius; although it does not specify the springs’ geographic coordinates, it constitutes a warning to the defendant that two springs exist on his property and that any development must take place outside that area. In SINAC’s complaint to the Public Prosecutor’s Office, official communication SOC-1434, it is stated that a permanent spring can be observed [Dirección2] meters from the dwelling; that document cites the coordinates of the property’s location, but not those of the springs. The municipal case file contains a construction-closure record dated 19 de noviembre de 2009, ordering the closure of [Nombre7]’s project because the construction is located within the protection area of spring 257, although it likewise does not cite that spring’s coordinates.
Forensic Engineering report 0718-ING-2011 was subsequently submitted, concluding that the house is located within 100 horizontal meters of the spring; it likewise does not identify the spring’s coordinates. Report DIGH-UGH-OF-086-2012 by [Nombre8] is the first to specify the geographic coordinates at which, according to SENARA’s records, spring NAC-1189 is located. That evidence was prepared at the request of the Public Prosecutor’s Office to determine the existence of the spring and its permanent nature, as well as to obtain a technical opinion analyzing the GEOTEC report contained in the Municipality’s case file, according to which what existed there was a stream; [Nombre8] concluded that there was a spring. The appellant continues that the municipal case file even contains an affidavit (declaración jurada), which the Court did not analyze, stating that the property is affected by the presence of an uncaptured water spring but that the construction is located outside the protection area.
On the basis of the foregoing, the appellant argues that the evidence corroborates that at least one spring existed on the property, that the building erected there was located within its protection area, and that the designation assigned to the spring—initially 257 and 258 and later identified in [Nombre8] as NAC-1189—neither affects nor bears upon proof of the alleged factual circumstances. He further argues that the geographic coordinates, which did not become part of the record until SENARA’s visit, after GEOTEC had already visited the site and established its coordinates, likewise do not affect the facts. This is due to an aspect that the Court neither addressed in its analysis nor assessed: the testimony of [Nombre10], who stated categorically that he visited the site and located a spring; that he later went to that same place with the expert from [Nombre11].; that he also went there with the expert from SENARA; and that on all thirteen occasions he always descended to the same emergence point.
It is therefore clear that the spring located at the site as the reference point is the same spring and is the one establishing that the completed construction lies within the 100-meter protection area. The GEOTEC report even locates spring 257 and establishes that it is the place where the stream originates, information that had not been provided by either the Municipality or SINAC in its complaint, since the complaint merely referred to the spring’s existence, but not to the stream’s origin. That circumstance was determined by Geologist [Nombre6] in his report, which the Court did not weigh. Moreover, figure 3.1 of his report identifies spring 257 as an uncaptured spring and the one closest to the property owned by the accused; it even identifies the point at the corner of the house. When compared with the engineering report, this leads to the conclusion that it is the same spring location and corroborates that the construction lies within the 100-meter protection area, none of which was assessed by the Court.
He states that the testimony of [Nombre5], [Nombre12], and [Nombre4] consistently identifies the point where the water emerges, corresponding to figure 3.1 of the GEOTEC report. Thus, despite the existence of evidence establishing the spring’s existence at the same location, the Court groundlessly held that doubt existed based on differing designations in the Water Directorate’s reports, without analyzing and comparing the evidence presented for the purpose of locating the body of water reported by SINAC. He requests that the judgment and the preceding trial be vacated and that the case be remanded for new proceedings.
As the second ground of the appeal filed by the Office of the Attorney General of the Republic, it is alleged that the judgment lacks a reasoned evidentiary basis (fundamentación intelectiva) and improperly assesses the evidence, in violation of the principle of freedom of proof (principio de libertad probatoria), in connection with [Nombre7]’s acquittal of the offense of violating the Ley Forestal and the dismissal of the civil action for damages (acción civil resarcitoria). He states that the Trial Court acquitted the accused because it considered that doubt existed as to whether he had acted with intent (dolo), which justified both the criminal acquittal and the dismissal of the civil action for damages. After transcribing part of the grounds of the judgment, he argues that the Court accepted the accused’s account that, in 2009, he hired an architect surnamed [Nombre9] to handle the procedures and obtain the land-use authorization (uso de suelo), which was sufficient for the judges to find it proven that Mr. [Nombre1] did not learn of the municipal warning.
The appellant states that the municipal case file contains official communication PUCC US 707 2008, in which the accused was warned of the existence of two water springs with a 100-meter protection area—which, under the Ley Forestal, is reserved for permanent springs—and which specifies that any development must take place outside that area. This was the only land-use authorization issued, since no other one was requested. He criticizes the Court for failing to note that the land-use authorization was issued in 2008, when the accused had not yet hired engineer [Nombre9], since that engagement did not occur until agosto de 2009, as shown by the professional-services agreement appearing at folio 32 of the municipal case file. This contradicts the accused’s account, which the Court nevertheless accepted. He adds that the municipal case file contains official communication 1321-1242-2009, issued by the I.C.E. on 23 de junio de 2009, stating that distribution lines for the service requested by the accused existed on the property where the events occurred; a document from the Tax Administration of the Municipality of Grecia, issued on that same date, certifying at the accused’s request that he was current on his municipal tax payments; and official communication RT-59-0000141231, in which the I.N.S., at [Nombre1]’s request, issued certification that a construction workers’ compensation policy had been taken out.
The appellant argues that these documents, which the Court did not assess, establish that before hiring engineer [Nombre9], the accused personally completed all the procedures, including the application for land-use authorization. Nevertheless, the Court refers only to the land-use authorization document issued by the Municipality and infers from that evidence that it cannot be established that the defendant knew its contents, because he stated in his testimony that he had hired someone to obtain the permits, although that person was hired one year after the application for land-use authorization was submitted. He adds that, according to [Nombre13]’s testimony, these documents were addressed not only to professionals but also to the persons concerned, so that they would know the restrictions affecting their property, none of which was analyzed in the judgment. He reiterates that the case file contains an affidavit concerning the existence of the uncaptured spring, a document that is not addressed to the Municipality and bears the issuance date 14 de agosto, the same day the professional-services agreement was signed.
The appellant questions how engineer [Nombre9] could have known of the restriction resulting from the springs’ presence if he signed the agreement that same day. In the appellant’s view, the answer is that the application for land-use authorization was in the accused’s possession. The appellant considers it implausible that the accused was unaware of documents issued at his own request and related to a substantial financial investment he had been making since 2007. He also criticizes the failure to assess the property survey plan (plano) submitted with the private criminal complaint (querella), which indicates that the property is 109 meters long. Accordingly, if the land-use authorization warned that the protection area could not be encroached upon, very little space remained for construction, making any development on that property unfeasible; nevertheless, the accused hired engineer [Nombre9] to carry out the project.
He reiterates that the agreement with the latter was signed one year after the land-use authorization document was issued and that the construction permit was issued by the Municipality in a single day, none of which was analyzed by the Court, even though it tended to establish the accused’s knowledge of the springs’ existence. He states that, according to SINAC’s complaint and [Nombre14]’s testimony, the project was closed on 18 de noviembre because it affected spring 257. The accused then hired engineer [Nombre6], who prepared the GEOTEC report, which was submitted to the Municipality without being reviewed or analyzed by any competent entity. Nevertheless, the Municipality issued no decision lifting the closure order, and the accused, despite the new warnings, completed the project. The Court’s findings were therefore incorrect, since the evidence indicates that the accused unlawfully completed the construction, as confirmed by witnesses [Nombre13] and [Nombre14], whose testimony was not properly assessed by the Trial Court, which erroneously concluded that they had lent credibility to the accused.
He adds that, when questioned as a suspect (indagado), the accused rushed to sell the property without warning the buyers that criminal proceedings were pending against him, which further supports the existence of intent.
It considers untenable the argument that there was a mistake of fact (error de tipo) because he did not know that the springs (nacientes) were permanent, since the warnings issued to him by the Municipalidad clearly stated that there was a 100-meter setback zone (zona de retiro), which the law provides only for permanent springs; moreover, this warning was reiterated by SINAC when it shut down the project, notwithstanding which he completed the construction. He requests that the judgment and the trial that preceded it be vacated and that a new trial be ordered. Because they contain repetitive and related claims, the preceding three grounds are addressed in the same recital (considerando) and are denied: Contrary to what the appellants contend, after a comprehensive review of the ruling and the contents of the case file (expediente), what this Court observes is that two technical expert reports (dictámenes técnicos)—offered by the prosecution and the defense—were introduced during the plenary hearing, and their conclusions contradict and mutually exclude one another.
First, the expert report (informe pericial) prepared by the company GEOTEC and endorsed by geologist [Nombre6] [Nombre6] (cf. folios 100 to 105), according to which the body of water under study constitutes the base flow of Quebrada Flores and forms part thereof, such that it is not a permanent spring within the meaning of subsection a) of Article 33 of the Ley Forestal. Second, report DIGH-UGH-OG-066-2012, prepared by the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) and signed by geologist [Nombre4] [Nombre4] and agricultural engineer [Nombre15] García Serrano (cf. folios 133 to 138), which concludes that the outcrop (afloramiento) in question is a permanent spring. Both expert assessments (peritajes) refer to the same body of water and agree that it is located less than 100 meters from the dwelling built by the defendant (imputado), [Nombre1]. That said, this Cámara de Apelación finds unpersuasive the claim that the Tribunal de Juicio should never have cited, as part of its reasoning, the study prepared by FUNDEVI and the Escuela Centroamericana de Geología of the Universidad de Costa Rica (UCR), because it was not introduced at trial.
First, the existence of that geological study has never been disputed; and second, the reports by [Nombre8], GEOTEC, and the Dirección de Aguas all draw relevant data from that study to support their respective conclusions for and against the existence of a permanent spring. Indeed, official letter DIGH-UGH-OF-066-2012—cited by the appellants in support of their position—expressly cites this same 2007 study prepared by FUNDEVI and UCR to assert that the reported site was located in an area of low-to-medium vulnerability to contamination of the Colima aquifer (acuífero) and of moderate-to-high aquifer recharge (recarga acuífera) (cf. folio 135). That information is precisely its starting point for asserting that the reported site constitutes a permanent spring evidencing an aquifer that emerges at the surface, because the FUNDEVI and UCR study indicates that a multilayer aquifer system could be found in the area, the one closest to the surface being known as the Sistema Secundario Colima, composed of tuffs and lava, which provided technical support for the existence of an aquifer at the indicated location (cf. folio 137).
As can be seen, [Nombre8]’s own report relies on data collected by FUNDEVI and UCR, such that challenging the existence and contents of this study would call into question all the prosecution expert assessments that the appellants cite in support of their arguments. At trial, the defense expert used this same study to assert that SENARE had erred, because the referenced aquifer was located elsewhere. As to the claim that the GEOTEC report contains no study of the water table (nivel freático), the appellants overlook the explanations provided at trial by geologist Rojas Castro, who stated in this regard that when he submitted his report, the present criminal proceeding did not exist and, consequently, neither did report DIGH-UGH-OG-066-2012, which several years later challenged the conclusions of his expert assessment; it was therefore necessary for him to elaborate on several points during the trial.
This appellate court finds geologist Rojas Castro’s explanation reasonable, particularly because the parties had an opportunity to question him exhaustively. In addressing [Nombre8]’s challenges to the study conducted by GEOTEC, expert [Nombre6] stated: “Geological conditions do not change; what do change are the conditions of the hydrogeological groundwater levels. This means that during some times of the year, when recharge occurs as water infiltrates, the level rises; at some springs, when that level rises, water emerges, while in summer the level drops. That is the change that occurs with groundwater. This is the criterion for determining whether it is permanent: when the water table rises and water emerges, the condition is that groundwater must exist. If an institution classifies an outlet of water as a spring, it must demonstrate that it is groundwater. That technical requirement is always mandatory here; it is required of those of us who conduct studies in this field.
When institutions ask that a point be classified as a spring and seek to determine where the groundwater level lies, there are no resources for doing so, and the matter is therefore left to the individual’s judgment, who applies a protection radius (radio de protección) that affects the governed parties (administrados). Without the study, it could not be said that there is a spring. In fact, I do not know who or which institution determines whether something is a spring; I only know the administrative-litigation jurisdiction (Contencioso administrativo). The Municipalidad supported my criterion, but in 2007 it commissioned a study from FUNDEVI of the Universidad de Costa Rica, which sells services using the UCR seal. That same year, there was a master’s thesis involving a geogeological study of the Cantón de Rio Cuarto de Grecia or the western region. As I understand it, the Municipalidad subsequently submitted it for [Nombre8]’s approval.
The Municipalidad invested 27 million colones; it is a working tool in that study mentioned in the SENARA memorandum. It contains equipotential groundwater lines (líneas isofreáticas), which are a map of the shape of the water surface in an aquifer. They identify three aquifers, and the shallowest consists of lava from the Unidad San Pedro. That map was prepared as part of the study, and if, at the time I conducted my study, the Municipalidad told me that its study showed no spring, that contradicts the assertion that the groundwater body was above. I do not know whether the Municipalidad used that study for decision-making; that study is not currently being used. That equipotential-line map—the same one prepared by UCR and approved by [Nombre8]—states that at that site in San Isidro, the surface is 70 meters below the place where they claim there is a spring. That study corroborates my study, and if the Municipalidad used that study as a decision-making tool, it acted correctly.
Their study says that it is about 70 meters below the place where there is allegedly a spring. It does indicate that for a spring to exist, there must be a water-table surface. The map shown was taken from UCR; it is the same as the one prepared for [Nombre16]’s thesis. The Municipalidad had that study and that map of the groundwater at the site, which I marked in red. In the document he prepared, [Nombre8] mentions the FUNDEVI study and used it as the primary argument for invalidating my work. The fact is that the FUNDEVI-UCR study validates my work. If the Municipalidad validated and accepted my work as correct, the Municipalidad had a technical tool: the study it had commissioned from UCR 4 years earlier. That map appears in a study cited as the principal argument by [Nombre8] and shows the shape of the water surface at the site. Shows diagram—the channel of Quebrada Flores; the site being identified as a spring is at [Dirección3] above sea level.
Lines connecting points of equal elevation, and it says that it is at elevation 1100, while the arrows indicating where groundwater flows in the area place it at approximately 1220. We therefore know that the groundwater is at elevation 1220. If we calculate the difference between the point of the alleged spring and the point where the groundwater level lies, there is a difference of 70 meters. That means the groundwater is 70 meters below. The 2004 national technical guidelines, which were published in La Gaceta as regulations, define an aquifer and also define groundwater, indicating what it is and that it lies below the water table. They define a spring as the place where the ground surface intersects the water table and water emerges there, but at this location the ground surface does not intersect the water table. It does not meet that condition; it does not intersect it and therefore does not meet the definition of a spring, and that map was issued using SENARA’s own criterion. [Nombre8]’s document says that the aquifer emerges at the surface and that, according to the study prepared by FUNDEVI, it is possible to find—reads—[this is] [Nombre8]’s principal argument for discrediting my work.
Is that true or not? It is false, because Colima is not at the site they are referring to. I do not know whether they failed to take the trouble to read the document they signed. It cannot be stated that Colima is there in San Isidro, because any geologist familiar with the geology of Grecia knows that this is not true. The principal technical argument they cite to invalidate my work is false […] Characteristic findings that must be observed to determine whether there is a spring: in some cases, because of the type of rock present, there are fractured lava formations and the water emerges spontaneously; in other cases, it is difficult to determine through visual inspection alone, and the existing studies must be reviewed to make that determination. A spring must undoubtedly have an influx of groundwater as a basic characteristic, unless artesian conditions (artesianismo) exist—that is, pressurized water—because water is present and emerges due to some effect.
In the case of Rio Rosales in Grecia, during the summer the water can clearly be seen emerging from the riverbed; one can plainly see that there is an upwelling and that artesian conditions exist. There are also other very exceptional cases, such as Ojo de agua, which lies in front of a lava flow. It is difficult to determine through inspection alone. Another characteristic is that it must be a fixed point: a spring cannot emerge in one place and then move a month later, because there must be a geological structure, possibly a fracture, that causes the water discharge (descarga de agua) to emerge. It must be a fixed point that is always there. One must be able to identify the aquifer containing the groundwater; for example, at some springs in Grecia, the lava fronts of the Unidad San Pedro clearly reveal the aquifer. It cannot be found in an area of clayey soil; the aquifer must develop within a permeable medium (medio permeable).
In rock such as lava, a spring may be found; in deposits like those present here, it may not. The water flows out and pushes forward, producing instability on that slope, and if decompression fractures (fracturas de descompresión) are visible, there are instability problems at the site. Folio 105 states that it was verified at the site that the spring is not the only one. At that time, I believe it was 257, which I insist had defined that block as a spring. What I did was locate what SINAC identified, and I located several water outlets; this was because water was flowing through the stream and among fallen blocks.
What I do in that document is use the SINAC information and say that, if you are considering—although I did not put it this way—that there are a lot of springs (manantiales) here that form a stream (quebrada), then apply the stream protection area. At that time, the matter was very basic; it was not a report intended to enter into a controversy or argue against the SINAC hypothesis. At present, if someone goes to [Nombre8] to conduct studies of this kind, they are asked to perform drilling. In conclusion, when I say that it forms an intrinsic part of Quebrada Flores, if that is the position being taken by SINAC, it must be understood to be baseflow (flujo base); if there is continuity from the spring (naciente), it continues there through the stream. “Intrinsic part” means that they are there as part of the stream’s flow. I plotted the springs with their coordinates; they were about ten meters from that lot.
I focused on the problem, which was 257. The conditions at the site do not permit a measurement to be taken; it is directly in the streambed (cauce) of the stream. It is very difficult; a measurement cannot be taken because of falling material. The water emerges from above; in my opinion, all the water falls from that area. The road from Grecia to San Isidro—everything west of it drains into that stream and runs off there. It is a complicated area because of instability. If something blocks the water outlet, in the photograph on the left the water flows elsewhere. At folio 100, the report is addressed to [Nombre17] because [Nombre7] asked me to address it to him. The study was conducted because the Municipalidad requested it. The soil study (estudio de suelo) is used to determine bearing capacity and slope settlement, and it is conducted in the field; in the field of animal husbandry, it is for civil works.
The Land-Use Study (Estudio del Uso de Suelo) does not exist here; the Municipalidad was requesting it, but no study is conducted for that purpose. Basically, the applicant (administrado) was required to hire an engineer or architect to submit it to the Municipalidad. A hydrogeological study (estudio hidrogeológico) is required to characterize a body of water (cuerpo de agua), while a land-use study is for engineering purposes, and I have conducted such studies.” As can be seen, the position maintained by the defense expert witness (perito de la defensa) is that the conclusions of the GEOTEC study are correct, whereas those of SENARA are not. First, this is because, according to the study by FUNDEVI and the UCR, there are no aquifers (mantos acuíferos) in the affected area, since the Colima aquifer is located in an entirely different and distant area; accordingly, that study, far from contradicting his conclusions, actually supported them.
Second, he states that the FUNDEVI and UCR document places the water table (nivel freático) in the area of interest at 70 meters, which is incompatible with SENARA’s assertions, such that the only way to establish with certainty that the body of water located near the residence built by the accused (imputado) was a permanent spring (naciente permanente) was through a hydrogeological study.
That being so, if the Ministerio Público and the Procuraduría General de la República sought the accused’s conviction for the offense of Encroachment on a Protected Area (Invasión a Área Protegida) (art. 58 inciso primero de la Ley Forestal), they were required to rebut the defense’s position. That is precisely what they failed to do in the case at bar (sub júdice), because, as discussed below, the judgment explains that the testimony of both [Nombre4] and [Nombre6] was extensive and clear and conveyed sincerity and an absence of any intent to favor or prejudice the accused; therefore, there was no reason to diminish their credibility.
Accordingly, the Trial Court (Tribunal de Juicio) decided to request a third opinion, this time from the Dirección de Aguas, which, according to SINAC memorandum OG-1212-2017 dated 25 de agosto de 2017 (cf. folios 646 and 647), is the entity competent to characterize a body of water in cases of doubt, in an effort to definitively clarify the nature of the site where the water emerges. The result was that this latter department was likewise unable to provide a definitive answer, for which reason the accused was acquitted pursuant to the benefit-of-the-doubt principle (in dubio pro reo).
Indeed, it is striking that both the appeal filed by the Ministerio Público and that filed by the Procuraduría General de la República present the Court’s reasoning in support of its doubt in a one-sided manner. Both appeals even purport to transcribe the grounds for the judgment; however, when those transcriptions are compared with the judgment, they are found to be incomplete, because essential arguments and statements made by the lower court (órgano de instancia) to justify the doubt were omitted.
With respect to this issue, the judges explained—in summary—that this case involved not only doubt regarding the nomenclature used by the various institutions responsible for safeguarding water resources (recurso hídrico) (SINAC, [Nombre8], and the Dirección de Aguas), as well as doubt regarding its georeferenced location (ubicación georeferencial), but also doubt as to whether the watercourse (afluente) having the characteristics identified by SINAC and [Nombre8] was a “spring.” They state that the prosecutors alleged the existence of two springs at the site, 257 and 258, based on the SINAC report prepared by [Nombre5] and [Nombre18], which reported that the construction carried out by the accused was located [Dirección4]. 5 meters from the watercourse that they identified as a spring, whose geographic location, according to its coordinates, was 233267 horizontal and 506347 vertical. In contrast, SENARE report DIGH-1092-11 informed the Fiscalía that, as of 17 de noviembre del 2011, a review of that institution’s database within a radius of 2000 meters around the accused’s property located a spring identified as NAC 1189, situated 82 meters from the site.
Nevertheless—the judges continued—after SENARA conducted its field study through report DIGH-UGH-OF-066-2012, the professionals who performed the inspection reported the location of a spring now situated at coordinates [Dirección5], concluding that it was NAC 1189, which had previously been recorded in that entity’s database, and that the distance between the structure and the water outcrop (afloramiento) was 48 meters. Thus, the two institutions did not even have a clear understanding of the nomenclature used to identify the body of water, and they provided different coordinates and distances between the location of the watercourse and the residence.
The judges explain that this same situation arises with Dirección de Aguas memorandum DA-UHTPCOSJ-2262-2021, which was requested by the Court a quo (Tribunal A quo). That memorandum does not recognize any of these designations and indicates that, although under memorandum DA-UHTPCOSR-0240-2019 that institution identified a watercourse as a spring at latitude coordinates [Dirección6] and longitude coordinates [Dirección7], a field inspection would be necessary to determine with certainty whether it was the same watercourse under inquiry or whether there were two independent springs. (This last point is omitted from the transcriptions in both appeals.)
The lower court continues by explaining that, at trial, the SINAC officials, [Nombre5] and [Nombre18], initially stated that the body of water was a permanent spring, a characterization based on the fact that water emerges at the site during every season of the year and that, based on their visits at different times throughout the investigation, it was clear that it was a permanent spring. However, both witnesses made clear that, notwithstanding the designation used by SINAC, the entity authorized to make that determination was the Dirección de Aguas. Witness [Nombre18] stated that they locate the spring and request an opinion from the Dirección de Aguas because they cannot say whether the spring is permanent; rather, they conduct an inspection and, if they find an outcrop, they report it to the Dirección Aguas or SENARA, but they cannot issue an opinion as to whether the outcrop is permanent and therefore act in accordance with the opinion of those entities. (This is omitted from the transcriptions in the appeals.)
The judges state that [Nombre8] conducted a field visit in connection with these proceedings. As a result, [Nombre4] explained at trial that, although he did not descend all the way to the watercourse, he determined from the photograph taken by his colleague [Nombre15] that the water outcrop was a spring, because the photograph clearly showed groundwater (agua subterránea) emerging and was consistent with what [Nombre15] and the SINAC personnel had said: there was fractured rock, water emerging from the rock, and this gave rise to the stream seen in the upper portion.
The witness stated that this fit the definition of a spring because it was groundwater emerging through fractures in the rock. Since they already had the survey prepared by the SINAC colleague, he searched the database of the Archivo Nacional de Pozos y Manantiales, which showed nearby wells that, due to the area’s topography, were deep, but all of them reported groundwater levels within rocks of volcanic origin, just like the outcrop where the fractures from which the water emerges are located, thereby giving rise to the spring.
The witness indicated that the existence of wells with recorded water levels meant that there was an aquifer, because if there were no aquifer in that area, no water would have been found. On the basis of that information, [Nombre8] determined that it was a permanent spring because the visit was conducted during the most critical part of the dry season. The witness also explained that, when he spoke of a progressively increasing flow of water, he meant groundwater emerging at the surface; the water was supplied by the groundwater, which emerged from an aquifer and thereby created a spring. (This portion is omitted from the transcription in the appeals.)
That being so, based on the statements made by witness [Nombre4], the Court concluded that characterizing the watercourse required more than merely establishing that it contained water during every season of the year; it was also necessary to prove that the water flow came from groundwater. This was consistent with the statement of expert witness [Nombre6], who indicated that this was the criterion for determining whether a spring was permanent: namely, when the water table rises and the water emerges. The condition is that groundwater must exist, such that if an institution classifies a water outlet as a spring, it must demonstrate that the water is groundwater, a technical requirement that is always mandatory in the country and is imposed upon those conducting studies in this field.
The Trial Court states that the two expert witnesses disagreed on this point. According to [Nombre4], although no drilling was conducted at the site to determine the groundwater level, the existence of wells at the site, which had already been referenced by [Nombre8] and by the Dirección de Aguas itself, supported the conclusion that the aquifer was at surface level, particularly because the hydrographic chart (carta hidrográfica) reported that the aquifer emerging at the site was the Colima aquifer.
For his part, geologist Rojas Castro maintained that this assertion could not be correct because, according to scientific studies conducted by FUNDEVI and the UCR laboratory, the equipotential groundwater level (nivel isofreático) in the area was below setenta metros and, consequently, the outcrop could not be associated with the Colima aquifer, which is located elsewhere and not in the district of San Isidro, where the defendant’s (encartado) property is located.
The judges state that, according to this expert’s testimony, determining whether a spring (naciente) existed required a hydrogeological study (estudio hidrogeológico), because the inspection revealed only a water outflow (salida de agua); therefore, the study had to establish the water’s origin, where it came from, and its characteristics, and the competent entity to conduct that study was the Dirección de Aguas. The Court then explains that, for this reason, despite the conclusion of the trial, and given the importance of determining with certainty whether they were dealing with a spring, an inquiry was submitted to the Dirección de Aguas. Although that entity reported that a site visit was conducted in 2019 at the location where the existence of an unnamed spring had been recorded, it could not determine, from the materials provided to it, whether the watercourse (afluente) located in that area at the indicated coordinates was a spring, because doing so required a study of the area.
Accordingly, in the trial court’s view, the only way to accept the opinion rendered by [Nombre8] and the testimony of witness [Nombre4], as sought by the prosecution, would be to establish the site’s classification as a spring merely by appealing to authority and stating that it was a spring because [Nombre8] and the Dirección de Agua had also described it as such; however, there was no clear explanation of how they had reached that conclusion. For both institutions, observing the site and the fact that water emerged there year-round would in themselves be sufficient to determine that it was a spring. Yet, beyond that observation—which appears highly empirical and not very scientific—when the method is questioned, both institutions fall short and fail to analyze the available evidence, or else state that answering the inquiry would require a more extensive study, once again leaving unresolved the possibility of testing those empirical assessments against the scientific method.
The adjudicating panel clarifies that it did not seek, merely on a whim, to challenge the determination of the Dirección de Aguas or the statement of the SENARA representative; rather, there was a regulatory provision that clearly defines what constitutes a spring. In this regard—the A quo continues—the Dirección de Aguas indicated that a spring is a flow of groundwater (agua subterránea) that emerges at the surface because of topographic changes, preferential zones, geological-structural features such as faults, or changes in hydraulic conductivity, fractures, or discontinuities. The judges reason that, according to the Dirección de Aguas itself, for a spring to exist, the water outflow must necessarily be connected to an aquifer (manto acuífero) and constitute its emergence point (punto de afloramiento). In this case, however, that could not be determined, considering that the FUNDEVI study, which is a public document and was used as a reference by [Nombre8] and in the GEOTEC report, identifies various groundwater depths at the site that differ greatly from the elevation above sea level at which the point under study was located.
The judges argue that, in addition, [Nombre8]’s potentiometric map (mapa isofreático) for the Alajuela area, which also appears on its website, shows that the Colima aquifer is extremely far from the San Isidro de Grecia area and that, according to that map, what exists there are potentiometric contours (curvas isofreáticas); no one had been able to answer the Court’s question as to whether the emergence under study was connected to those contours or, alternatively, to which specific aquifer it was connected and at what depth that aquifer was located. The judges continue by explaining that, although it might be said that a field inspection was required to provide that answer, such an inspection would itself be more scientific and would rely on data already collected at the site, such as the depth of wells previously drilled in the area or information held by various state entities, including the Universidad de Costa Rica, making it possible to establish the groundwater level at the site and whether it coincided with the location of the emergence, instead of simply taking that for granted without providing further grounds.
The A quo concludes that, for these reasons, it could not clearly find that a spring existed at the site or that it was permanent. Having assessed this reasoning against the contents of the case file (expediente), this appellate Court finds that the grounds for the judgment comply with the rules of rational evaluation (crítica racional) and are consistent with the evidence. First, this Chamber does not find excessive the Trial Court’s characterization of the SENARE and Dirección de Aguas reports as empirical. Whether the conclusive assertions in a report may be classified as scientific does not depend exclusively on the standing or prestige of the issuing entity, as the appellants erroneously assume—because that would entail committing an appeal-to-authority fallacy—but rather on whether the conclusion resulted from applying the scientific method to the examination of the specific case. The Procuraduría’s complaint is therefore unacceptable, because the mere physical accumulation of documents issued by different institutions (SINAC, SENARE and Dirección de Aguas) stating that a permanent spring existed at the site would not, by itself, suffice to establish certainty on that point if the assertion were not supported by compelling scientific studies that unquestionably rebutted the defense evidence (prueba de descargo).
Indeed, upon reviewing report DIGH-UGH-OF-066-2012, this Court notes that geologist [Nombre4]—unlike geologist [Nombre6]—considered the descent to the location of the water outflow dangerous and therefore did not conduct an in situ analysis of the emergence, but instead analyzed it through a photograph. As correctly explained in the judgment, expert [Nombre4] himself confirmed at trial that what specifically characterized an emergence as a permanent spring was that its source consisted of groundwater flow from aquifers. It is therefore untrue that the adjudicating panel failed to assess [Nombre8]’s technical opinions and expert [Nombre4]’s trial testimony. On the contrary, the Trial Court was correct in finding that it is insufficient for a report simply to state that a water outflow was observed and that it displayed certain characteristics that might initially be compatible with permanent springs (e.g., broken rock), unless the origin of the water was confirmed.
Consequently, no error is apparent in the judges’ analytical reasoning when they credited expert [Nombre6]’s challenges to the prosecution evidence (prueba de cargo). The Procuraduría is therefore incorrect in criticizing the conclusions of the GEOTEC expert report because, irrespective of the report’s reference to the presence of several water sources (manantiales), expert [Nombre6] explained at trial where this water came from and ruled out its being groundwater that gave rise to a spring within the meaning of artículo 33 of the Ley Forestal. Accordingly, the alleged contradiction is not apparent, since the document does not imply that these emergences originated in the Colima aquifer—as SENARA did conclude—or in underground water sources. Nor is the claim persuasive that it would be illogical, according to the GEOTEC report itself, for there to be a water emergence of 0.5 to 1 litro por segundo without a groundwater supply.
This argument disregards expert [Nombre6]’s explanation on the subject: “In the area there are discharges of wastewater (aguas residuales), rainfall, and all that water flows to the site identified as a spring; there are septic tanks with their drainage systems, but the water moves downward and enters the subsoil, emerging somewhere, namely at the lowest point. Water was observed discharging in the area; this was in 2012. Landslides have occurred there, and [Nombre8]’s report refers to cracks. Because of the terrain, cracks develop at the location in what is called the free face (cara libre), and decompression always occurs toward the slope. Water runs along the slope, and those are the sources of that water; when it reaches that location, the water continues to flow even in summer, but we already know that it is water running through the site and cannot be groundwater because the latter is located 70 metros below the surface.
The Sinac report identifies a series of springs, 257, 258, because water falls everywhere there; however, the Sinac map shows a spring, NAC 1189, and the number CED2 A is a well that was constructed, constituting what is known as captured water (aguas captadas). I do not know whether that is a spring or captured water; it was used for agriculture, but it is no longer there, and according to the database that point is 180 metros from the house. [Nombre8] indicates that Nac 1189 is the subject of the dispute and places it in the green area that was deforested within the property owned by [Nombre7], moving it by cien metros; but that is the upper part, where there is grass and a pipe that collects water from the road and carries stormwater (aguas pluviales). It is a change: it was in one place, it was under concession, and now they place it somewhere else.” (Verbatim copy) As may be seen, the doubt identified by the Trial Court is supported by the evidence.
The appellants fail to rebut the Court’s arguments and instead confine themselves to asserting that, if an emergence existed at the investigated site during both winter and summer, its source necessarily had to be groundwater. But in a case as unusual as the one before us, without a hydrogeological study confirming that fact, it may be asserted only as circumstantial evidence (indicio) of a permanent spring, not with the certainty required for applying criminal law. Contrary to the assertions in the grounds for appeal, the court of first instance states in its judgment that, according to the position advanced by geologist Rafael Matamoros, and specifically on the basis of the FUNDEVI and UCR study itself, the surface waters (aguas superficiales) referred to by SENARE would come from the Colima aquifer. However, according to [Nombre8]’s potentiometric map for the Alajuela area, which also appears on its website, the Colima aquifer is extremely far from the San Isidro de Grecia area, and what exists there, according to that map, are potentiometric contours; no one had been able to answer the Court’s question as to whether the emergence under study was connected to those contours.
It is therefore untrue, as the Procuraduría asserts, that the A quo merely cited expert [Nombre4]’s testimony without analyzing its contents, since an intellectual assessment of the prosecution evidence is apparent here. For the same reasons set out above, the Trial Court was correct in stating that the official communication (oficio) of the Dirección de Aguas DA-UHTPCOSR-0240-2019 (cf. folios 924 a 929) adds no further substantive information to that reported by SENARA, to the effect that the spring was classified as permanent essentially because it maintained its flow during summer (cf. folio 926); however, that report likewise does not state that any hydrogeological study existed confirming that its source was groundwater. Therefore, the Trial Court’s statement that this was a predominantly empirical opinion cannot be characterized as incorrect. The adjudicating court asked the Dirección de Aguas to analyze the Comprehensive Hydrogeological Study (Estudio Hidrogeológico Integral) in the western sector of the cantón de Grecia, No.
113-A5-402, which was available on the Municipalidad de Grecia’s website and was public information, as well as SENARA’s hydrogeological map, which was also available on its website; it also asked the Directorate to clearly delimit which aquifers (acuíferos) were located in the study area and, if they were located beneath that area, to indicate their depth and whether they were related to the outcrop (afloramiento) under study, as well as to determine whether potentiometric contour lines (curvas isofreáticas) existed at the site and what relationship they might have with the outcrop under study. The Directorate’s response in official letter DA-UHTPCOSJ-2262-2021 was that the hydrogeological study had not been analyzed and that, in order to consider it for a new expert opinion (dictamen), one of its geologists would need to review it, and issuing an opinion would entail analyzing all the materials mentioned, as well as conducting a field inspection during the period of lowest rainfall in the Grecia area (verano 2022), while determining the aquifers would also require a study of the area (cf. folio 921).
As can be seen, taking into account that, specifically in the case under review, the prosecution and defense experts disagreed regarding the presence of aquifers in the area where the studied outcrop was located, as well as the existence of underground flows supplying it—an essential factor for classifying it as a permanent spring (naciente permanente)—the adjudicating panel decided to consult the Dirección de Aguas because, as the latter itself confirmed in official letter DA-UHTPCOSJ-2262-2021, under decreto 35669-MINAET, only the Dirección de Agua has the authority to issue expert opinions on bodies of water. However, the response received was that no hydrogeological study had been conducted and that a field visit would be necessary in the verano de 2022. Consequently, the Procuraduría is incorrect in asserting that this official letter resolves the doubts that led to application of the in dubio pro reo principle in this specific case.
Likewise, the argument that the credibility of expert [Nombre6] should be diminished because he was deemed accommodating in proceedings entirely unrelated to the present case is unacceptable. That would require the Trial Court to abandon rational sound judgment (sana crítica racional) in favor of applying rules of predetermined evidentiary weight (prueba tasada). Therefore, regardless of whether the appellants consider questionable the statements in the GEOTEC report that the studied outcrop is supplied by rainwater, that is insufficient to support a conviction because, as the Trial Court correctly explains, it was incumbent upon the prosecution to establish with certainty that the water supplying the outcrop on the defendant’s property came from underground flows fed by aquifers, which it never did, since, inexplicably, from the investigation stage onward it never requested the relevant studies from the Dirección de Aguas del MINAET, until that evidence was requested by the Trial Court on its own motion.
Furthermore, regarding the appellants’ claims concerning the alleged lack of reasoning for the doubt as to the identity and location of the outcrop, it is again apparent that the appellants quote the Trial Court’s reasoning only in fragments. Indeed, when the adjudicating panel’s complete reasoning is transcribed, it shows that the judges argued as follows: “[…] although official letter 199-11-2011 at folios 74 to 75 and its addendum at folios 122 to 126 from the Servicio Nacional de Aguas Subterráneas, Riego y Advenimiento preliminarily reports that, following a preliminary review of that institution’s database, it was determined that within a radius of 2000 meters around the coordinates indicated by the Fiscalía in its request, there were reports of 12 registered wells, 2 illegal wells, and 17 springs, and that the nearest spring was the one they identified as NAC 1189, which, according to the preliminary report, was located 82 meters from the site.
In the subsequent addendum prepared by officials [Nombre15] García and Rafael Matamoros, those officials concluded that the water outcrop at the site was a permanent spring and that it was the spring NAC 1189, which they now reported as being only 48 meters from the house, while those reports provided markedly different geographic coordinates for the tributary (afluente). Accordingly, the Court considers the information in official letter DA-UHTPCOSJ-2262-2021 relevant to determining whether this is the same body of water referenced in the land-use certificate (uso de suelo) or in [Nombre8]’s report, or instead a different body of water. In this regard, the Dirección de Aguas informed the Court that ‘...It is reported that the nomenclature CED3 and CED4 is specific to SENARA. A review of its website did not locate the coordinates of the springs designated 257 and 258, and it is therefore impossible to verify the requested information.
As for NAC 1189, according to [Nombre8], it is located at coordinates CED5 and CED6, near the spring addressed in official letter DA-UHTPCOSR-0240-2019; a field inspection would be necessary to verify whether they are two independent springs or the same spring.’” It later added: “The Ministerio Público and the Procuraduría have asserted that two springs exist at the site, 257 and 258, based on the SINAC report prepared by [Nombre5] and [Nombre18], which stated that the construction erected by the defendant was located 71. 5 meters from the tributary they identified as a spring and that its geographic location, according to its coordinates, was CED7 horizontal and 506347 vertical. For its part, report DIGH-1092-11 from the Servicio Nacional de Aguas Subterráneas, Riego y Advenimiento informed the Fiscalía that, as of 17 de noviembre del 2011, a review of that institution’s database within a radius of 2000 meters around the location of the accused’s property identified a spring designated NAC 1189, located 82 meters from the site.
However, once that entity conducted the field study documented in report DIGH-UGH-OF-066-2012, the professionals who attended the inspection reported the location of a spring now situated at coordinates CED8 [Dirección8] and [Dirección9] east longitude, concluding that it was NAC 1189, previously registered in that entity’s database, and that the distance between the structure and the outcrop was 48 meters. In other words, the two institutions are not even clear about the nomenclature used to identify the body of water, and they provide different coordinates and distances between the tributary and the dwelling. The same occurs with official letter DA-UHTPCOSJ-2262-2021 from the Dirección de Aguas, which the Court requested: that Directorate does not recognize any of this nomenclature and states that, although in official letter DA-UHTPCOSR-0240-2019 that institution referenced a tributary as a spring at coordinates latitude CED9 and longitude CED10, a field inspection would be necessary to conclude with certainty whether it was the same tributary addressed in the inquiry or whether they were two independent springs.” Although it is true that the complaint (querella) filed by the Procuraduría charges that the defendant’s construction encroaches upon the protection area (área de protección) of one of the springs located within his property, without specifying which one (257 or 258), the problem is that doubts exist as to whether the outcrop reported by SINAC, which gave rise to the complaint at folios 1 to 14, is the same body of water that SENARE subsequently declared to be a permanent spring.
The Procuraduría’s argument essentially consists of asserting that, because SINAC official Eliden Alcázar visited the outcrop on three occasions, accompanying both the Forensic Engineering expert and the SENARE officials, it must be the same location. However, this explanation is contrived. SINAC report SOC-1434 states that a measuring tape and GPS georeferencing equipment were used to establish the location of the outcrop, producing a distance of 71,5 meters (cf. folio 1). However, report DIGH-UGH-OF-066-1012 states that a measurement was taken using a Garmin-brand GPS system (high-precision) and ArcView 3.3. software, producing a distance of 48 meters. It is readily apparent that these are two markedly different locations, calculated using advanced technological equipment, so Mr. Eliden Alcázar’s presence during both proceedings does not clarify the matter. The issue becomes even more complicated because report DA-UHTPCOSJ-2262-2021 reveals that the numbering CED11, CED12 and CED4 is specific to [Nombre8] and that, after its website was consulted, the coordinates of these springs were not found, making it impossible to verify the information requested by the Court, while, as regards CED13, fieldwork was necessary to determine whether it was the same spring addressed in official letter DA-UHTPCOSR-0240-2019 or whether they were two independent springs.
It is therefore impossible to conclude with certainty, as the appellants speculate, that the body of water evaluated by SENARE (48 meters from the house) is the same one reported by SINAC ([Dirección10] from the house), and that either of these actually corresponds to the registered springs CED14 or CED13, as described in the charging instruments (piezas acusatorias). In any event, even if it could be established that it was the same outcrop, because it could not be determined that it was a permanent spring, the proper course was still to apply Article 9 of the Código Procesal Penal.
Furthermore, with respect to the absence of criminal intent (dolo) on the defendant’s part, it is again apparent that the appellants truncate the Trial Court’s reasoning. On this issue, the judgment explains that: “[…] in their closing arguments, the prosecution stated that the accused first acquired knowledge of the fact (an element of the criminal offense) on 03 de julio del 2008 through official letter PUCC US 707-2008, a document issued by the Municipalidad de Grecia referring to the existence of two uncaptured springs (nacientes no captadas) and stating that part of the property was located within the protection zone (zona de protección), meaning that no construction project could be developed within a radius of 100 linear meters. Because this document was addressed to the accused, it was clear that he received it and that, from that moment onward, [Nombre1] knew of the springs and their protection radius.
Nevertheless—the two prosecuting entities allege—that despite this knowledge, the accused waited one year—as part of his plan—and, on 27 de agosto del 2009, submitted to the Municipality an application for a building permit for a one-story family dwelling with a construction area of 120 meters, whereupon the Municipalidad de Grecia granted him the permit for the construction of that dwelling in the record time of one day—which, according to the Fiscalía, was also circumstantial evidence to be considered in establishing the accused’s knowledge that his conduct was unlawful. The Procuraduría’s representative further argues that the accused clearly knew that the water outcrop along the northern boundary of his property constituted a spring because he waited up to one year before completing the procedures with the Municipality, having had the opportunity during that year to obtain advice in order to determine whether constructing his dwelling complied with the law.
The prosecution (fiscalía) and the Procuraduría consider that the only conclusion to be drawn from this circumstantial evidence is that the accused (encartado) knew of the existence of the body of water and its protection radius (radio de protección), and therefore knew that construction at the site was prohibited. The Court finds that these arguments lack evidentiary support—as analyzed supra—because the very evidence for the prosecution renders the indicia ambiguous; specifically: a) First, regarding official letter PUCC US 707-2008, as witness [Nombre13] indicated, these types of procedures were often not carried out personally. Although they are addressed to the owner or titleholder of the property, that person is not necessarily the one who submits the application or collects it from the municipality. The witness stated: “...Anyone may submit the land-use authorization (uso de suelo) application.
I have been hired for special cases because it is very complicated, but they are always handled as though the private party (administrado) were submitting the application. The application was made by the gentleman because it was signed by him and bears his identification number, but anyone could have submitted it…” (emphasis added). In this case, we have no evidence to disprove that, as [Nombre1] testified at trial, he had retained professional services to carry out all procedures before the municipality, as is apparent from the digital case file (Expediente digital) of the Municipalidad de Grecia and from the Geotec Report itself. These establish that [Nombre7] received advice from the architect in charge of the project, who even submitted an affidavit (declaración jurada) in the municipal case file stating that the tributary did not prevent construction of the contracted dwelling because it was not within the protection radius.
The file also contains a report—addressed to the person who was then responsible for construction permits, [Nombre17] Corrales—concerning the study of the spring (naciente) conducted by Geotec, which states that although a body of water exists, it is part of the base flow of Quebrada Flores and that the protection radius is neither the one indicated by the municipality in the land-use authorization nor the one reported as a spring by [Nombre19] and [Nombre8]. The evidence instead substantiates [Nombre1]’s account that he was unaware of the existence of a spring affecting his property and that, when he became aware of it, he sought advice from the person assisting him at the time. He then submitted the hydrogeological study (estudio hidrogelógico) requested by the municipal official responsible for permits and was thereby able to complete construction. b) The speed with which the construction permit was issued and the length of time that elapsed before the defendant applied for it after the land-use authorization had been granted could, as [Nombre7] duly stated in his testimony, have been due to his having a contact within the municipality who told him that he could help, or to the need to secure the financial resources for construction.
The defendant had to arrange two mortgages with two different institutions to build the dwelling, as established by the registry report and [Nombre3]’s testimony. Alternatively, as the case file already demonstrates, it may have been because he lacked the money for construction or was in no hurry to build and was merely processing the paperwork required to begin his project. Furthermore, witnesses [Nombre13] and [Nombre5] both consistently stated that the Municipalidad is responsible for reviewing these documents, that the land-use authorization is a necessary requirement for processing a construction permit regardless of when it was issued, and that the professional in charge of the Departamento de Planificación Urbana—at that time [Nombre17]—was obligated to verify compliance with these requirements and either grant or deny the construction permit. [Nombre13] stated: “...A land-use authorization is required for a construction permit...the cadastral plan with approval (plano catastro con visado), the land-use authorization, the letters confirming the availability of water and electricity, and the remaining items were very straightforward: revenue stamps, municipal taxes paid up to date, plans stamped by the Colegio de Arquitectos, and the construction plans...The official then grants or denies it. [Nombre17] is a former colleague, an architect in charge of Urban Planning; I do not remember what year he joined, perhaps 2006, and he left in 2017.
He never held a supervisory position over me; he thought he was everyone’s boss, but he was not my boss. His job was to issue construction permits...” None of the factors relied upon by the prosecution and the Procuraduría are weighty, unequivocal, and consistent enough to establish that, in 2009, [Nombre1] knew what “spring” meant, that it was “permanent,” and that, because this classification affected his property, constructing there would violate the Ley Forestal.” As can be seen, the Trial Court’s reasoning went far beyond the few lines quoted in both appeals and, contrary to the assertions made therein, also addressed the arguments advanced by both the Ministerio Público and the Procuraduría in their closing submissions. Turning now to the appellants’ claims, the first point to note is that although page 6 of the digital case file of the Municipalidad de Grecia shows that the land-use authorization is addressed to Mr. [Nombre1], there is no acknowledgment of receipt.
The appellants assume that a copy of that document was delivered directly to the interested party, an inference they draw from the fact that it was addressed to the defendant and that the case file contains other official letters issued at his request. However, these other documents likewise contain no acknowledgment of receipt, making witness [Nombre13]’s statement—that these procedures could be handled by anyone, not necessarily the directly interested party—particularly relevant. That statement is also consistent with the defendant’s account that he entrusted these procedures to other persons. In other words, there is no evidence that this document was ever actually in Mr. [Nombre1]’s possession. Moreover, although the affidavit signed by the architect surnamed [Nombre9] is dated August 2009, the appellants appear to assume—again, without any supporting evidence—that this professional’s involvement in the construction of the defendant’s dwelling began on the very day he signed that affidavit.
Ordinary experience indicates, however, that people interested in building or remodeling homes generally hire architects beforehand; the architects begin preparing designs and documents and arranging municipal permits, and once the initial stages of document collection have been completed, they submit the contracts to the Municipalidades. Thus, the fact that the contract in this case was dated August 2009 does not, per se, rule out the possibility that the architect surnamed [Nombre9] had been assisting the defendant for some time. As the appellants themselves assert, an investment as substantial as the construction of a dwelling requires the interested party to seek assistance from persons knowledgeable in the field, and that entire process takes time. Yet even assuming hypothetically that Mr. [Nombre1] read official letter PUCC US 707-2008, witness [Nombre1], referring to its contents, stated: “The document is a technical document that is difficult for a private party to interpret but easy for colleagues of mine who provide independent professional services to interpret.
At that time, no affidavit of this kind was submitted stating that the protection zone (zona de protección) was being respected.” It follows from this person’s testimony that the mere fact that the private party to whom the document was addressed read its contents did not necessarily mean that he would immediately understand its meaning and legal implications—specifically, in this case, what a “spring” is and what conditions it must meet to be considered “permanent.” More importantly, a reading of official letter PUCC US 707-2008 shows that the private party was never prohibited from building the dwelling; he was merely warned that part of the property lay within the protection area (área de protección) of uncaptured springs 257 and 258, without their specific locations being indicated, and that the building therefore had to be erected outside the one-hundred-meter radius. It is noteworthy that the appellants selectively quoted certain statements by witness [Nombre13] regarding land-use authorizations being addressed to private parties, while omitting the portion in which the same witness acknowledged that decisions of this kind are difficult for ordinary citizens to understand.
This is where the affidavit of engineer [Nombre9], found on page 35 of the municipal case file, becomes particularly significant, because this professional, who was directly responsible for the project, stated that the construction was located outside the protection area. The appellants read this document selectively in order to conclude that Mr. [Nombre1] possessed official letter PUCC US 707-2008. This Appeals Chamber (Cámara de Apelación), however, considers that the document instead supports the Trial Court’s conclusion that the defendant had placed the construction in the hands of this professional, who was responsible for supervising it. Mr. [Nombre1]’s account that he later learned that the house he was building might be affecting a protection area is therefore credible. In other words, given that an engineer was shown to have been in charge of the project, there is no evidence supporting the assertion that the person subject to trial (justiciable) had reason to distrust what professional [Nombre9] stated in the affidavit or that he even knew that the information recorded therein was incorrect.
For this same reason, the Procuraduría’s argument that the defendant should have known, based on the property plan, that no development could be carried out on the property is likewise untenable. First, this argument rests on an inference adverse to the defendant (in malam partem) that he possessed the technical expertise necessary to read and interpret a plan and to calculate how much of his property could be developed. Second, nothing in the plain wording of official letter PUCC US 707-2008 indicates that the private party was prohibited from building. It merely states that the structure had to be located outside the protection area. If space constraints made it unfeasible to build a house there, the person responsible for determining that was precisely engineer [Nombre9], not the private party. To that extent, the appellants never explain the basis for their contention that the accused compelled this professional to proceed with construction despite knowing of the restriction, or that the two had agreed to disregard it.
Third, returning to the hiring of a professional, the appellants also fail to explain what evidence could support the assertion that the defendant had reason to distrust [Nombre9]’s assurances, as the person responsible for the building, that there was no problem with the construction, or that don [Nombre7] possessed the technical expertise necessary to suspect that the engineer’s statement in the affidavit might be false, when that statement indicated that the construction would not affect the area of the water outcrops (afloramientos de agua).
On the other hand, it can be seen that the appellants distort the witnesses’ statements regarding the stoppage and resumption of the construction work. On this point, the defendant (imputado) stated as follows: “After about three or four days, they were working when the Municipality arrived with some seals and sealed off the construction work, and I was shocked by what was happening. I did not ask the person who placed the seals anything; I went to the Municipality and asked Mr. [Nombre17]—I do not remember his surnames—and the other gentleman, Esteban. Very worried about what was happening, I asked them, and Mr. [Nombre17] told me that my only option was to submit a study—I do not know whether it was geological; I do not remember the term. He recommended a Mr. [Nombre6]. I explained the matter to him, and he very kindly told me that he would help me. I gave him the information and the address of the property.
He went to the property; it took about seven or eight days, and I was very worried. One day, Mr. [Nombre17] called me and told me to come down. I went to the Municipality; [Nombre17] was in the office with Esteban. I was afraid of what they were going to say. [Nombre17] told me: You can build whatever house you want in that location. He was very pleased to see that it was a stream. I remember that was on a Monday, and on Tuesday at 8:00, Mr. [Nombre17] and [Nombre14] went up to remove the seals and told me that I could continue with the construction work. I was happy. This architect, [Nombre9], went to see the construction work every day and never told me anything. When they stopped the construction, the house was 75 percent complete. When he went up and removed the seals, I called the workers and construction resumed. It continued normally; everything went well. The house was completed without incident; everything went well.
Once the house was finished, I moved there for a few days. I was very happy with the house, and one month later I received notice of what was happening.” Regarding the closure (clausura) of the construction work, witness [Nombre14] stated: “As for whether the construction work was completed, [Nombre17] dealt with that. As far as I know, [Nombre17] was in charge, because when the closure of the construction work was lifted, another inspector handled it, since we were rotated. I was not the one who went at that time to remove the seals with [Nombre17]; normally, he was the one who went […] [Nombre17] was the head of the Engineering Department. I do not know why he signed in the space for the person in charge of the construction work. The signature above the designation ‘witness’—I remember that, at the time, it belonged to the construction foreman who was at the site; he was the one who signed there.
All the information I entered in the record was entered while I was accompanied by [Nombre17]. He went with me to carry out that procedure, and he told me what I had to enter in the record that day. The section concerning progress of the construction work appears in the percentage field, which states 80. I do not remember whether I had previously visited that location. In theory, a closure cannot be lifted and the seals removed if the site is within the radius of a spring (naciente), but my supervisor was the one who made those decisions […] [Nombre17], who was the supervisor, had to authorize the lifting of the closure of the construction work […] I mentioned that because, on another occasion, they said right here that the seals had been removed, but I did not learn when or by whom. I do not know whether they were removed; I have no personal knowledge of that.” [Nombre5] stated: “[…] we undertook to collect more information and photographs, measure the area of the house, and investigate at the Municipality whether it had permits.
We interviewed engineer [Nombre17], who told us that it did have a permit. The information was collected and submitted to the Grecia Prosecutor’s Office. When we spoke with [Nombre17], we informed him that the spring was there, and he told me that if a geological study of the spring were submitted, he would issue the permit. I did not know whether there was a geological study; we did not have access to the case file. The first visit was in November 2009. I do not remember whether I spoke with [Nombre17] that same day or on subsequent days. I do not know whether the construction work was closed; I understand that it was not […] I do not know whether [Nombre17] knew that the spring existed, but he only told me that if they submitted a technical study, he would issue the permit.” Similarly, [Nombre6] stated: “The study was conducted to assess certain alleged springs identified in that area by Sinac. [Nombre7] needed to have it conducted because, when he was going to build a house, a complaint was filed and the Municipality was required to suspend the construction process.
They requested the study, and he submitted it to the Municipality of Grecia. At that time, the Municipality did not have a specialized department to conduct those assessments, so it sought technical advice on environmental matters from a private consultant such as myself to determine whether they were in fact springs. I believe [Nombre7] contacted me in late 2009, and I submitted the study in early 2010 […] I knew [Nombre17] at the Municipality; he is an architect who served as the municipal engineer, and I believe he is the person who requested the study […] On folio 100, the report is addressed to [Nombre17] because [Nombre7] asked me to address it to him. The study was prepared because the Municipality requested it.” For his part, [Nombre13] stated: “At that time, there were no geologists at the Municipality. Sinae and [Nombre8] do have geologists; I cannot evaluate the private work they perform.
There may be a setback (retiro) that partially affects the property, in which case construction is permitted outside that area, or it may affect the entire property, in which case construction is not permitted. If approval is granted, construction may proceed, but it should not because the law is being violated. The Municipality accepted private geological studies. These were extremely expensive studies, and technical analyses were requested in an effort to demonstrate that these springs had been incorrectly designated. Once these studies were commissioned and received by the Municipality, it lacked the capacity to evaluate them, so they were referred to [Nombre19]. It took a year or more to determine whether the feature was a spring and whether construction was permitted. This was done while I was there. It was requested from the taxpayer. This was done before construction, when you, as the owner or the owner’s professional, had doubts as to whether it was a spring, so that the matter could be referred to the Water Directorate.
On some occasions, the studies were useful and the springs had been incorrectly designated; in most cases, they had not, and the designation was correct.” As can be seen, contrary to the assertions made in the appeals, these witnesses state that, at the time of the events, private parties subject to the Municipality’s authority (administrados) could submit private geological studies to the Municipality to demonstrate that a spring had been incorrectly designated as such. They also support the account that the Municipality asked Mr. [Nombre1] to submit a geological study ruling out the presence of permanent springs near the construction area as a condition for allowing him to complete it. Moreover, they show that the information available was that [Nombre17] was the person who handled the matter, removed the seals, and authorized the construction work to continue. More importantly, regardless of whether the Municipality’s administrative case file contains a decision ordering the removal of the seals—an issue that could never be attributed to the private party, but rather to the Municipality’s officials—it is clear that the GEOTEC study was conducted at the request of the interested party and concluded that the water outcrops located within the defendant’s property were not permanent springs.
This openly refutes the appellants’ contention that the defendant acted with conditional intent (dolo eventual), on the ground that inspectors from the Municipality of Grecia informed him that the construction work encroached upon a spring protection area (área de protección), for which reason it was closed, yet he nevertheless continued. On the contrary—and this is established with certainty—Mr. [Nombre1] was provided with an expert report (dictamen pericial) prepared by geologist [Nombre6], which stated categorically that the water outcrops identified by SINAC were not permanent springs but rather a stream. This was precisely the same information available to the defendant and allowed him to complete the construction. With that report in his possession, it cannot be asserted that Mr. [Nombre7] acted with conditional intent by proceeding with the construction work, since he had a technical opinion—which had not been refuted by any authority at that time—according to which the structure he was building did not encroach upon any protection area (unless the appellants could demonstrate that the defendant possessed the technical knowledge, or had well-founded reasons to doubt the conclusions of the GEOTEC report endorsing the legality of the construction work, which they do not).
Finally, according to the judgment’s proven facts, it is not true that the defendant “rushed” to sell his property upon learning of the criminal proceedings, since those proceedings began in 2009, the defendant was formally questioned (indagado) on 14 de junio de 2011 (cf. folio 17), and the residential property was not negotiated for sale until 2011, that is, two years after the proceedings were initiated. None of this can be applied “retroactively” to 2009, when the house was built, to allege that he acted with intent at that time. For all the foregoing reasons, the grounds for appeal are denied.
II.As the third ground of appeal, the appellant challenges the admission, incorporation, and rejection of testimonial evidence (prueba testimonial), with the resulting erroneous application of Articles 204 and 352 of the Code of Criminal Procedure (Código Procesal Penal). The appellant claims that the Court did not allow the Office of the Attorney General of the Republic (Procuraduría General de la República) and the parties to conduct a thorough examination of the witness [Nombre17], who was offered by the defense and mentioned by several witnesses as the municipal official who approves the municipal permit, orders the closure, communicates with SINAC officials, and receives the GEOTEC report. He was therefore an important witness for establishing the processing of the municipal permit and the issuance of the land-use certificate (uso de suelo), as well as the information that led to the closure of the project and the Municipality’s possession of information concerning the springs (nacientes), including what happened to the GEOTEC report after it was received by the Municipality and whether the defendant was present at the Municipality before the municipal permit was issued.
Nevertheless, before taking his testimony at trial, the Court found that this witness had the status of a suspect, even though neither the Public Prosecutor’s Office nor the Attorney General’s Office had ever treated him as a person under investigation and, moreover, more than 10 years had elapsed since the events. The Court’s sole argument was that this witness had been mentioned in the SINAC report in connection with the issuance of the municipal permits. The appellant states that he filed a motion for reconsideration (recurso de revocatoria), pointing out to the Court that this witness had never been regarded as the perpetrator of any offense and that, in any event, he should have been allowed to testify; only if his testimony revealed possible self-incrimination should the Court have assessed, in light of those circumstances, whether it was necessary to advise him of his rights. However, the Court denied the motion and appointed a public defender for him, who advised him to refrain from testifying, making it impossible to examine the witness.
The appellant states that this prejudiced the Attorney General’s Office because it was prevented from examining a very important witness, particularly given that the Court acquitted the defendant based on doubt as to his knowledge of a document issued by the department where the witness [Nombre17] worked, who was the person who issued the construction permit. The appellant reiterates that, pursuant to Article 204 of the Code of Criminal Procedure, the proper course was to allow the witness to testify and, only if some responsibility became apparent, to advise him of his rights. The appellant finds it noteworthy that, in declaring him a suspect, the Court assessed the SINAC report even though he had never been treated in this case as a possible perpetrator of an offense, thereby evaluating evidence in a manner that was impermissible at this procedural stage. The appellant requests that the challenged judgment be vacated and the case remanded for a new trial.
This ground is denied. In this Chamber’s view, this testimonial evidence does not have the significance that the appellant seeks to ascribe to it because, as explained in the preceding recital (considerando), even hypothetically assuming that Mr. [Nombre1] appeared at the Municipalidad de Grecia to collect the construction permit, that document’s contents are not readily understandable to an ordinary member of the public—unlike construction professionals—and therefore simply reading it does not establish, as the appellants assume, that he fully understood what a permanent spring (naciente permanente) was, exactly where such springs were located on his property, and where he was prohibited from building. Moreover, the land-use certificate does not prohibit construction; it merely gives instructions that construction must remain outside the protection area (área de protección). There was also a sworn statement (declaración jurada) by the engineer in charge of the project reporting that the residence would be located outside that area, and the prosecuting parties failed to demonstrate, through compelling arguments, why the responsibility of engineer [Nombre9], who was responsible for constructing the residence, should be transferred to Mr. [Nombre1], or what evidence could establish with certainty that the defendant had reason to doubt the information given to him by the engineer he retained—namely, that there was no impediment to constructing the residence where it was built—or reason to doubt the conclusions of the GEOTEC study that the water outcrops (afloramientos de agua) located less than one hundred meters from his house were not permanent springs.
In addition, the preceding recital explained that it was also not established with certainty that the water outcrops identified by SINAC and [Nombre8] were permanent springs, an essential element for establishing the statutory offense (tipo delictivo); this situation would not have changed with Mr. [Nombre17]’s testimony, and therefore vacating the proceedings on this ground is likewise unwarranted. In any event—and for the sake of completeness—the adjudicating body (órgano juzgador) does not appear to have acted arbitrarily. The fact that a person has not been investigated in the proceedings does not preclude treating that person as a suspect witness (testigo sospechoso) insofar as the person may be exposed to making statements that incriminate him or her as the perpetrator of a criminal offense. Regarding this issue, the appellant omits several particular circumstances that arose in this specific case.
First, by the time the witness [Nombre17] was called to the stand, the complaint filed by SINAC, appearing at folios 1 to 4, had already been admitted into evidence at trial and expressly stated: “If it is determined that Mr. [Nombre1] bears no responsibility for the reported events, we request an investigation into the conduct of the Engineer of the Municipalidad de Grecia to determine whether an unlawful act occurred in granting the permit within the protection area of a permanent spring.” It should be noted that this document already identifies him as a possible perpetrator of an offense against integrity in public service (probidad en la función pública). Furthermore, while it is true that this person was mentioned by other witnesses, the appellant fails to state what they said. A review of the judgment shows that, regarding [Nombre17]’s involvement in the events, [Nombre14] stated: “I am shown folio 187; that is my handwriting and the closure report that was prepared; it is the one I have been shown on other occasions.
My signature is in the center, where it says Inspector; on the left edge, above the line for person responsible for the project, [Nombre17]. [Nombre17] was the head of the Engineering Department; I do not know why he signed in the place designated for the person responsible for the project. The signature above the witness designation, as I recall, belonged to the construction foreman who was there at the time; he was the one who signed there […] I do not remember seeing a construction permit posted, although I know that the project had a permit because [Nombre17] told me so, but I do not remember seeing it in the field. [Nombre17], who was the head, had to approve lifting the closure of the project […] I do not know whether [Nombre17] could perform the duties of an Inspector. He went with me because he knew that the project had a permit; he went to the site with me because he had to handle the matter.
An Inspector was required to close a project […] Normally, two people, [Nombre17] and the assistant, would check whether or not the property was affected. I do not know why they did not realize it in this case, or perhaps it was not affected, because they conducted checks before granting a permit. Before this, I do not recall having performed this type of procedure.” For his part, [Nombre13] stated: “I learned that the construction permit had been granted because a friend of mine, who was a witness, was in the witness room and because all of this happened as a result of a construction permit being granted. The witness told me that it had, but I have no personal knowledge of whether the project was closed. At that time, a cadastral plan (plano catastro) bearing an approval stamp (visado), the land-use certificate, letters confirming the availability of water and electricity, and the remaining, very simple requirements were needed: stamps, proof of being current on municipal taxes, a plan stamped by the Colegio de Arquitectos, and the construction plan.
The official there either grants or denies the permit […] A construction permit may be revoked and could later be issued again. There must be an administrative act (acto administrativo), and the municipal council must review the case. The permit is issued by a professional from the Planning Department. I know that, at that time, certain permits involving administrative problems had been revoked. I do not know whether it was the same situation, but when a closure occurs, it is intended to allow the member of the public to address what the municipality has requested. The closure notice must tell the member of the public the reason for the closure and grant a certain period, as established by law […] The member of the public had to request the approval stamp and the land-use certificate from the municipality; both took 15 days to be delivered. The requirements for the permit were generally handled by the member of the public or the professional, who had to gather all the remaining requirements from a list of 8 to 10 requirements provided by the municipality; the plans had to be stamped and assessed by the Colegio.
That packet was submitted to the municipal service desk so that it could be forwarded to urban planning and construction control, which took 10 days to grant or deny the construction permit or license. The professional had to review everything submitted by the member of the public. If there was any doubt, assistance was requested from the Legal or Cadastral Department, and if the doubt persisted, a more qualified professional was consulted. If there was any doubt, [Nombre19] had to be consulted to verify the existence and number of springs. There are protocols establishing the duties of each professional, but internal controls were not as specialized as they are now; I do not know whether or not the professional followed them.” It should be noted that, in addition to the SINAC complaint, the witnesses’ testimony in this particular case reveals potentially improper conduct by Mr. [Nombre17] in the performance of his duties, not only regarding the allegedly hasty issuance of the construction permits but also regarding authorization to resume the project without complying with administrative procedures.
This was already sufficient for the Court, at that time, to foresee that this person’s eventual testimony could expose him to liability for his involvement in these events. In a case very similar to the one before us, the Judgment Appeals Court (Tribunal de Apelación de Sentencia), in decision No. 2020-1121 at 10:25 on July 8, 2020—incompletely cited by the appellant—held as follows: “The arguments raised challenge the fact that it was not possible to obtain meaningful information by reproducing the witness’s prior statement, much less that the private complainant (querellante) and civil plaintiff (actor civil) were allowed to conduct an effective examination to establish the liability of the defendant and civil defendant. This was because, although the judge did not follow the usual procedure when taking the statement of a ‘suspect witness’ (constitutional advisements regarding the right to refrain from testifying and to have the assistance of counsel, because such a person must be afforded the same treatment as any defendant), he nevertheless restricted the parties by prohibiting them from asking questions whose answers might result in ‘self-incrimination.’ As a preliminary matter, it should be clarified that a witness ‘is a person who, without being a defendant, states what he or she knows about the facts at issue in the proceedings, such knowledge having been acquired through any of the person’s senses.’”
(Llobet Rodríguez, Javier, Proceso Penal Comentado, 6ª edition, San José, Editorial Continental, 2017, p. 349), whereas Article 81 of the Code of Criminal Procedure provides that an accused person (imputado) is “any person who, through any investigative or procedural act, is identified as a possible perpetrator of or participant in the punishable act,” thereby establishing limits on State and private punitive action in order to protect the rights and guarantees afforded to each such person in the proceedings, including the right to legal assistance and the right to refrain from testifying (derecho de abstención) (Article 36 of the Political Constitution), and even the right of witnesses to refrain from testifying in the circumstances contemplated in section 205 of the Code of Criminal Procedure. This preamble supports the conclusion that, although it is true that, pursuant to Article 204 of the Code of Criminal Procedure, a witness has a legal duty to comply with a judicial summons and to testify under oath, this duty is subject to exceptions, including where the witness exercises the right to refrain from testifying by virtue of a relationship of consanguinity or affinity with the accused, under the rules of section 205 of the Code of Criminal Procedure; where the facts about which the witness is required to testify could expose the witness to criminal liability (a situation that, in practice, has been termed a “suspect witness” (testigo sospechoso)); or where the witness is an accused person who was acquitted or whose case was dismissed (sobreseído) in relation to the events about which the witness is to testify.
In other words, when the record of the proceedings reveals the possibility that the person may bear some responsibility for the events under investigation or charged, as applicable, or even that the person may incriminate himself or herself (although no party has characterized the matter in that manner), that person (the “suspect witness”) has the right to refrain from testifying and to be represented by legal counsel (patrocinio letrado). Although establishing and determining this status has presented serious difficulties, since it may even give rise to arbitrariness, it nevertheless follows from section 91 of the Code of Criminal Procedure, which provides: “When there are sufficient grounds to suspect that a person has participated in the commission of a punishable act, the official of the Public Prosecutor’s Office responsible for the investigation shall take that person’s statement in accordance with the provisions of this Code” (boldface not in the original); however, that status (of “suspect witness”) may validly be excluded when the “suspicion” conferring that status disappears or dissipates over the course of the proceedings as a result of the admission of lawful evidence that rules out the person’s involvement in the punishable act, or when a prosecutorial discretion criterion (criterio de oportunidad) has been applied pursuant to Articles 22 and 23 of the Code of Criminal Procedure and, after the expiration of the fifteen-day period following the judgment’s becoming final, the prosecuting authority’s intended outcome has been achieved.
Regarding this situation, it should be noted that if, in this particular case, the Public Prosecutor’s Office or the Office of the Attorney General of the Republic, as holders of the criminal action (acción penal), decided not to charge [Nombre21] and reserved the possibility of calling him as a witness because of his minimal participation, for example, they had the actual and legal ability to apply this mechanism and thereby avoid these disputes. However, because they did not proceed in that manner, the legally expected course was for the court, before taking [Nombre21]’s statement, to inform him of his constitutional right to refrain from testifying and afford him the opportunity to be assisted by a public defender or counsel of his choosing; in any event, this did not relieve the judge of the duty to remain vigilant and identify any circumstance that might expose the declarant to liability, and thus to take action to safeguard his rights.” Naturally, whether the Trial Court must, before hearing a witness, advise the witness of his or her status as a “suspect” and inform the witness of the right to refrain from testifying must be assessed in light of the characteristics and particular circumstances of each specific case, since in many instances there are no objectively ascertainable elements that would reasonably permit the Court, ex ante, to determine that the person might incriminate himself or herself by testifying.
Such elements may therefore come to light only when the person gives testimony, which is why the judges must listen very carefully to the person’s account and be prepared to inform the person of his or her rights and advise him or her of the possibility of assistance by defense counsel. In this particular case, however, according to the evidence presented at trial, such indicators did exist and were timely perceived by the Court; accordingly, the adjudicatory panel acted in accordance with law by informing Mr. [Nombre17] that he could be assisted by defense counsel. For the foregoing reasons, this ground is denied.
III.As the fourth ground of appeal, the appellants challenge the reopening of the proceedings (reapertura del debate) ordered by the Court, alleging a lack of intellectual and evidentiary reasoning and a violation of the principle of evidentiary freedom (libertad probatoria). They object that, after the closing-argument stage had concluded, the Trial Court ordered the proceedings reopened pursuant to Article 362 of the Code of Criminal Procedure, but never explained the need to request such new evidence, particularly because technical evidence had already been introduced into the proceedings under the principle of evidentiary freedom. After transcribing the responses submitted by the Dirección de Aguas to the Trial Court, they object that the institution informed the adjudicatory body that it was unable to address some of its concerns because doing so would require more time and, moreover, an inspection would have to be conducted in the summer of 2022.
This technical issue was already known to the Court, since from the outset the geologists who testified during the proceedings stated that a study of this nature had to be conducted during the dry season. Nevertheless, without providing reasons, the Court decided to request a technical opinion in the middle of the rainy season; then, after the Dirección de Aguas issued its report, the judges relied on certain aspects of it to characterize the Dirección de Aguas study as “empirical,” question the technical information, and heighten the doubt. They request that the challenged judgment be vacated and the case remanded for new proceedings. This ground is denied. Article 362 of the Code of Criminal Procedure provides: “If, during deliberations, the court considers it absolutely necessary to receive new evidence or expand upon evidence already admitted, it may order the proceedings reopened for that purpose.
The discussion shall then be limited to examining the new elements of assessment introduced.” It should be noted that the wording of the provision does not indicate that, in order to reopen the proceedings, the Court must provide an extensive explanation for its decision. The only requirement is that, during deliberations, the judges consider the evidence absolutely indispensable; it is sufficient that they notify the parties of their decision, and the parties must, in any event, be given access to examine this new evidence. The article does not provide the parties with the opportunity to object to the reopening and/or challenge the Court’s reasons. Therefore, the appellant’s argument that this evidence was unnecessary because sufficient technical evidence already existed to establish the alleged facts constitutes a particular assessment of the case that, by itself, does not establish that the Trial Court acted arbitrarily in this specific instance.
As explained in the second whereas clause (considerando segundo) of this decision, the adjudicatory body was faced with conflicting opinions in the expert reports (peritajes) prepared by SENARE and Geotec regarding the characterization of the bodies of water located on the defendant’s property. Accordingly, this Chamber considers that it was reasonable to consult the Dirección de Aguas, which is precisely the entity competent to determine whether a water outcrop (afloramiento) may be classified as a permanent spring (naciente permanente). Commenting on the scope of Article 362, national legal scholarship states: “This is a problematic provision from the perspective of judicial impartiality […] It assumes that evidence may be reopened both to request evidence that could prejudice the defendant and to request evidence that could favor the defendant […] In practice, however, proceedings are reopened in cases in which the intent is to introduce incriminating evidence against the defendant.
The correct approach is that, if doubt exists during deliberations, the proper course is to issue a judgment of acquittal rather than reopen the proceedings to order additional evidence […] Logically, when proceedings are reopened, the court may not order inculpatory evidence (prueba de cargo), but only exculpatory evidence (prueba de descargo), as proposed by [Nombre22]; nevertheless, this remains problematic because, contrary to what is intended, the result may ultimately prejudice the defendant […] It must be emphasized that, if doubt exists, the proper course is to acquit. In practice, however, the reopening of proceedings has not followed that standard and is frequently ordered in an effort to complete the Ministerio Público’s incriminating evidence, contrary to the accusatorial principle and the principle of impartiality […] The justification offered for evidence ordered upon reopening the proceedings is that it constitutes a measure to obtain further evidence (medida para mejor proveer) based on the principle of ‘material truth’ (verdad material).
It should be exercised only in exceptional cases because it disrupts the ordinary course of the proceedings. Therefore, receiving new evidence must be ‘absolutely necessary’” ([Nombre23], Javier. Proceso Penal Comentado. San José, Editorial Jurídica Continental, 6° edición, 2017, pp.- 546-547). Based on the foregoing, if the Trial Court had doubts in this case regarding the characterization of the body of water under examination, it should have acquitted the defendant outright by applying the principle of in dubio pro reo, instead of reopening the proceedings to request this report from the Dirección de Aguas, the result of which could very well have supported the prosecution’s theory. Consequently, the assertion that this action by the Trial Court caused “prejudice” to the Ministerio Público and the Procuraduría is unacceptable, since this new evidence could readily have strengthened their position that the water outcrop was indeed a permanent spring because it was fed by groundwater, thereby allowing the Court to favor the expert report prepared by SENARE; thus, the person who could have been prejudiced was Mr. [Nombre1] himself.
Nor is the claim that this evidence was irrelevant well founded, given that geologist [Nombre4] had warned that field investigations of this kind, such as those requested by the Court from the Dirección de Aguas, had to be conducted during the dry season. As stated in the second whereas clause of this decision, responsibility for this situation cannot be shifted to the adjudicatory body because, if it was known from the outset that the Dirección de Aguas was legally responsible for characterizing a water outcrop, it is unclear why neither the Ministerio Público nor the Procuraduría General de la República requested a technical opinion from that agency during the preparatory stage (etapa preparatoria). The Court is therefore not responsible for the fact that, when its members determined that this study was necessary, the Dirección de Aguas was unable to conduct it because of the time of year in which the proceedings took place.
It bears repeating that this problem would not have arisen if the prosecuting party had previously ensured that this evidence was placed in the record. For the foregoing reasons, this ground is denied.
IV.As the fifth ground of appeal, the appellants allege a lack of reasoning for the denial of the request to demolish the structure. In summary, they contend that the judgment’s reasoning on this issue is insufficient because it does not analyze the evidence establishing the existence of a spring and a protected area (zona de protección), but, above all, because it provides no legal reasoning and fails to take into account the precautionary and pro natura principles, which must be observed when actions affecting the environment are involved. This ground is denied. The problem with the appellant’s argument is that, in every case giving rise to the judicial precedents cited—both those of the Sala Constitucional and those of the Courts of Appeal—it was established, notwithstanding the defendant’s acquittal, that a protected area had been encroached upon and that actual environmental harm had occurred.
That, however, is precisely what was not established in the case under review. Indeed, the facts found proven in the judgment were as follows: “FIRST: In 2008, the defendant [Nombre1] built a dwelling on the property located in San Isidro de Grecia, [Dirección11], , a property registered in the Alajuela registry district under real-property folio number CED15, geographically located at horizontal coordinates [Dirección12] and vertical coordinates [Dirección13], Naranjo map sheet, scale 1:50.000, measuring 3.300 square meters and through which a body of water flows. SECOND: In April 2011, the accused [Nombre1], knowing of criminal proceeding number 09-204266-0331-Pe brought against him for the offense of violating Ley Forestal, the subject of that forestry violation being the property in the Alajuela registry district under real-property folio number CED15, sold it to the injured parties [Nombre2] and [Nombre3] for the sum of ONE HUNDRED THIRTY MILLION COLONES, concealing from them criminal proceeding 09-204266-0331-PE, which concerned restrictions on the property that made it impossible for them to enjoy it, thereby causing them economic harm to their assets.
THIRD: The accused [Nombre1] has no prior convictions.” It should be noted that one of the reasons the defendant was acquitted was precisely that the prosecution’s technical evidence was insufficient to establish that the body of water was a permanent spring. If so, the existence of environmental harm cannot be asserted either, and under these circumstances ordering the demolition of the structure would be arbitrary. For the foregoing reasons, this ground is denied.
POR TANTO:
The appeals against the judgment filed by the Ministerio Público and the Procuraduría General de la República are denied.

Intervienen en la decisión del recurso, los jueces José Alberto Rojas Chacón, Yadira Godínez Segura y Karina Redondo Gómez. Se apersonan en apelación de sentencia, el licenciado Arturo Figueroa García, en condición de representante del Ministerio Público, el Procurador Penal, Randall Aguirre Mena y la licenciada Jeannette Salazar Araya, en condición de representante legal de la querellante y actora civil, señora [Nombre2] .
RESULTANDO:
Redacta el Juez de Apelación de Sentencia Rojas Chacón; y,
CONSIDERANDO:
I.Como único motivo del recurso de apelación de sentencia interpuesto por la representación del Ministerio Público, se reclama fundamentación contradictoria, violación a las reglas de la sana crítica e inconformidad con el análisis de las pruebas. Fustiga al Tribunal haber realizado un análisis selectivo y erróneo de la prueba, pues sin valorar en forma integral los criterios técnicos recibidos, encontraron dudas en cuanto a la comprensión que pudiera tener el imputado sobre las exigencias del tipo penal previsto en el artículo 58 de la Ley Forestal y sobre el carácter de la naciente, ya que los juzgadores consideraron que era necesario establecer la existencia de un acuífero en la zona, y pese a lo indicado en juicio por el perito hidro geólogo, [Nombre4] , quien explicó el motivo de una naciente en la zona y de una invasión al área de protección, el A quo se decantó por un argumento que no se sostiene, pues señalan que el estudio de FUNDEVI, utilizado para establecer la existencia de la naciente, señalaba que existía una diferencia en cuanto a la profundidad de las aguas en el sitio, con relación al nivel del mar, indicando que no existió perforación, pero los jueces dejaron de lado los criterios de varios profesionales geólogos y técnicos en la materia, que claramente refirieron que las características de rompimiento en las rocas, la condición topográfica y la existencia de pozos en la zona, determinaban la existencia de acuíferos y que históricamente el cuerpo de agua resultaba ser una naciente que da origen a la quebrada Flores, que inicia desde la naciente y no hay más aporte que el subterráneo, que dicha naciente mantiene su caudal durante todo el año, siendo permanente y así lo declararon [Nombre4] y [Nombre5] .
Luego de transcribir un fragmento del fallo, reprocha al Tribunal de mérito no haber analizado que, ya desde la solicitud de permisos, se aportó al imputado información clara de la existencia de nacientes de agua en la zona y que debía respetar el área de protección, pero, violentando la sana crítica racional, el A quo razona que, aun cuando el imputado era el interesado en la obra, cualquier otra persona podía recibir todos los documentos que se iba agregando al expediente de construcción, y como existía un ingeniero encargado de la obra, no tenía el acusado por qué conocer dichos documentos. Sin embargo, el apelante considera que el fallo es omiso en su análisis, al establecerse que en presencia del encartado clausuraron la obra, que en la visita del 18 de noviembre de 2019 estuvieron presentes los personeros del SINAC para dichos efectos, y que pese a la clausura posterior a la visita (cuando ya el conocimiento de la existencia de la naciente era claro), continuó con sus obras invasoras en el sitio.
Fustiga que el fallo pretenda establecer que, pese a lo anterior, se desconocía que infringía la ley. Considera que el fallo es ayuno de fundamentación en este extremo, pues según la prueba recibida y el correcto entender humano, ante dichas circunstancias se debía acudir a fuentes que podrían, ya desde ese momento, establecer claramente la existencia de la naciente que estaba invadiendo con la construcción realizada, dejando de lado que desde el 2007, en documentación relacionada con la construcción, se le venía indicando que la existencia del área de protección en la zona (expediente de la Municipalidad de Grecia). Luego de citar otros extractos del fallo, acusa que el análisis probatorio fue sesgado y las exigencias del Tribunal rebasan los criterios técnicos recibidos en debate, pues dejaron de lado lo dicho por el geólogo [Nombre4] [Nombre4] y los últimos dictámenes emitidos por la Dirección de Aguas, que establecían la existencia de una naciente en la zona.
Reclama que el Tribunal se apartó del principio de libertad probatoria, puesto que la existencia de la naciente se podía demostrar a través de cualquier medio de prueba idóneo, pero en su lugar se reabrió el debate sin fundamento, para obtener un criterio del Departamento de Aguas, que pese a establecer la existencia de la naciente en la zona, no fue suficiente para el Tribunal sentenciador, pues aduce una duda por la nomenclatura utilizada al ubicar la naciente, una duda por la ubicación de los puntos en estudio denominadas nacientes, dejando de lado que, pese a la nomenclatura y las coordenadas utilizadas, todas ellas establecían una invasión mayor o menor al área de protección, circunstancia que no afectaba la comprobación de una invasión en el caso concreto, pues incluso el informe del GEOTEC, realizado por [Nombre6] , establece la existencia del manantial o naciente 257, que da origen a la quebrada Flores y se ubica a [Dirección1] de la finca, determinándose la invasión con la declaración de este perito.
Reclama que no se analizó el comportamiento posterior del imputado, como tampoco se motiva por qué no se ordenó el reestablecimiento de las cosas al estado anterior, vulnerando el principio pro natura. Solicita se anule el fallo impugnado y se ordene reenvío en lo relacionado a la Infracción de la Ley Forestal. Como primer motivo del recurso interpuesto por la Procuraduría General de la República, en su condición de querellante y actor civil, se reclama falta de fundamentación intelectiva y errónea valoración de la prueba, con violación al principio de libertad probatoria en lo relacionado con la absolutoria de [Nombre7] por el delito de Infracción a la Ley Forestal, declarando sin lugar la acción civil resarcitoria. Refiere que se acusó al encartado haber invadido la zona de protección de las nacientes 257 y 258, pese a haber sido advertido por la Municipalidad de Grecia sobre la existencia de éstas y el deber de realizar la construcción fuera del radio de los 100 metros, pese lo cual levantó la edificación dentro de dicha zona.
Señala que el Tribunal sustentó la absolutoria en la duda sobre la caracterización del cuerpo de agua existente en el lugar, así como una duda en la ubicación de ésta. A ello opone varios reclamos: a) En cuanto a la duda sobre la existencia de aguas subterráneas a nivel superficial, que incide en la determinación de la naciente en la propiedad del imputado. Luego de transcribir un fragmento de los fundamentos del fallo, reprocha que el Tribunal trató de manera injustificada de empíricos los informes técnicos emitidos por instituciones serias como el [Nombre8] y la Dirección de Aguas, estudios que fueron incorporados con el propósito de validar de manera parcial el criterio del geólogo [Nombre6] [Nombre6] (aportado por la defensa), y a partir de ahí sustentar la existencia de una duda. Señala que, según el Tribunal, no bastaba con una inspección en el sitio, sino que debía hacerse un análisis para poder establecer el nivel freático existente en el lugar y, a partir de ello, establecer si hay un afloramiento.
Señala que este argumento, en esencia, se basa en un estudio de FUNDEVI y de la Universidad de Costa Rica elaborado en el 2007 (que no fueron aportados al contradictorio), que se citan únicamente por el [Nombre8] en el oficio DIGH-UGH-OF-086-2012 como una referencia de ubicación en general de acuíferos, y el cual es cuestionado luego por el perito de la defensa, utilizando justamente la afirmación de que el nivel freático en el sitio se encuentra a 70 metros. Sin embargo -prosigue el apelante- el Tribunal dejó de valorar y analizar una serie de elementos probatorios que explican por qué en el sitio el nivel freático era superficial y no se encuentra a 70 metros y mucho menos que se requiera determinar la profundidad de los pozos para poder establecer este aspecto. Reprocha que los jueces se limitan a citar el informe de GEOTEC, emitido por [Nombre6] , en el cual ni siquiera existe un análisis imperante en el nivel freático, llamando la atención que no fue examinado por el Tribunal, el cual se quedó con unas afirmaciones emitidas en el contradictorio por dicho geólogo, pese a que en el informe de GEOTEC contiene una serie de afirmaciones que dan cuenta de que en el sitio existen brotes de agua, pero concluye de manera contradictoria que lo que existe ahí es una quebrada.
Señala el apelante que el Tribunal afirma que se debía realizar un estudio de aguas subterráneas, porque existe un estudio de FUNDEVI y la UCR emitido en el 2007 que establecen una zona geográfica amplia (no en el lugar de los hechos específicos) que el nivel freático estaba a 70 metros, de lo que deriva que no hay afloramiento. Sin embargo, los jueces no valoran que en el informe de GEOTEC, en donde se establece que en el lugar existen brotes de agua, que hay un grupo de manantiales e incluso que aflora un caudal pequeño de orden de los 0.5 litros por segundo, cuestionándose el apelante cómo sería esto posible si el nivel freático estuviera a 70 metros, lo cual no es lógico, pese a lo cual los jueces afirman que era necesario un análisis de éste, porque un estudio del 2007 señalaba que el nivel freático estaba a 70 metros en una zona geográfica, argumento que riñe con la derivación de la prueba y los hallazgos en el sitio que se consigna en el informe de GEOTEC del año 2010.
Por otra parte, acusa que el Tribunal no valoró que en el informe del [Nombre8] DIGH-UGH-OF-086-2012 se explica, desde el punto de vista técnico, por qué en el sitio sí había una naciente, prueba que no fue valorada, de ahí que no es sostenible el argumento de que no existe una explicación técnica del por qué en el lugar no existen aguas superficiales que provienen del agua subterránea, lo que implica que el nivel freático es superficial y de ahí la inexistencia de una naciente. Considera que el Tribunal parte de premisas falsas al considerar empíricos los informes técnicos, donde se explica por qué el nivel freático era superficial (por lo que no era necesario el estudio que los jueces echan de menos), como también cuando apela a criterios de autoridad para señalar que sólo por ser [Nombre8] hay que creerle y considerar qué es una naciente. También fustiga que no se analizó lo depuesto por el geólogo Rafael Matamoros, quien dijo que al visitar al sitio encontró fractura de roca, lo cual solo es posible si existe agua subterránea que aflora y que para que nazca una quebrada se necesita gran cantidad de agua saliendo a la superficie, lo cual se determinó con base en la inspección que realizó el geólogo del [Nombre8] al lugar de los hechos y se deriva de las afirmaciones contenidas en el informe del GEOTEC, nada de lo cual fue analizado y, en su lugar, se hizo prevalecer un estudio del 2007.
Cuestiona que el Tribunal tampoco valorara lo que el mismo perito de la defensa dijo sobre la existencia de brotes de agua y el hecho de que, para explicar esto, lo que hay son aguas servidas que hacen que el agua salga a la superficie, pese a que en el propio oficio DA-UHTPCOSR-240-2019 de la Dirección de Aguas, traído al proceso e incorporado por el propio Tribunal, se afirma que en el sitio no hay aguas pluviales y que el caudal inicia en la fractura del paredón y se mantiene en época seca y lluviosa en el mismo punto, que es una naciente donde nace la quebrada Flores. En consecuencia, sí es una naciente para la Dirección de Aguas, por el hecho de que existe afloramiento de aguas subterráneas. Cuestiona que el perito [Nombre6] fue complaciente y no es la primera vez que en un proceso penal sostiene que hay una quebrada donde hay una naciente, sin que en la sentencia hay pronunciamiento sobre los cuestionamientos que hizo la Procuraduría en sus conclusiones a este perito.
Agrega que en el expediente de la Municipalidad hay una declaración jurada del Ingeniero [Nombre9] Alfaro la cual descarta que en la finca haya descarga de aguas servidas, como afirmó el perito [Nombre6] . El apelante enumera una serie de informes y oficios incorporados como prueba que, a su criterio, es contundente respecto al carácter de naciente permanente del cuerpo de agua que se ubica en la propiedad y fustiga que el Tribunal haya dudado de la existencia de aquella, por el hecho de que no se hicieron estudios de profundidad de aguas subterráneas, acusando que esta prueba fue valorada de manera fraccionada y omisiva. b) En cuanto a la existencia de la duda sobre el lugar de la ubicación de la naciente: Luego de transcribir un fragmento de los fundamentos del fallo, señala que los hechos que se imputan al señor [Nombre1] es que, pese a haber sido advertido por parte de la Municipalidad sobre la existencia de dos nacientes de agua no captadas, denominadas 257 y 258 dentro de su propiedad, y que la construcción debía realizarse fuera de los 100 metros de área de protección, hizo caso omiso y construyó su vivienda, por lo que el thema probandum del proceso se limita a establecer su dicha edificación fue levantada dentro del área de protección de dichas nacientes, Señala que el oficio PUSS-US-707-208 (expediente municipal) dirigido al imputado, advierte la existencia de dos nacientes no captadas dentro de su propiedad y que el desarrollo debe estar fuera del radio de los 100 metros y, aunque no se especifican las coordenadas geográficas de las nacientes, es una advertencia al encartado de que existen dos nacientes en su propiedad y la obligación de realizar cualquier desarrollo fuera de dicha zona.
En la denuncia del SINAC al Ministerio Público, oficio SOC-1434, se indica que a [Dirección2] metros de la casa de habitación se observa una naciente que es de carácter permanente, documento donde se citan las coordenadas de ubicación del inmueble, pero no de las nacientes. En el expediente municipal consta un acta de clausura de obras de fecha 19 de noviembre de 2009, donde se clausura la obra de [Nombre7] porque la construcción se ubica dentro del área de protección de la naciente 257, aunque tampoco se citan las coordenadas de ésta. Luego se aporta el dictamen 0718-ING-2011 de Ingeniería Forense, que concluye que la casa se encuentra dentro de los 100 metros horizontales de la naciente; tampoco se ubican las coordenadas de la naciente. El informe DIGH-UGH-OF-086-2012 del [Nombre8] es el primero que detalla las coordenadas geográficas donde, según los registros del SENARA, se ubica la naciente NAC-1189, prueba que se realizó a solicitud del Ministerio Público para determinar la existencia de la naciente y el carácter permanente de ésta, así como para contar con un criterio técnico que analizara el informe de GEOTEC que se encontraba en el expediente de la Municipalidad, según el cual lo que había ahí era una quebrada, concluyendo el [Nombre8] que había una naciente.
Incluso -prosigue el apelante- en el expediente municipal hay una declaración jurada, no analizada por el Tribunal, donde se establece que la propiedad tiene una afectación de una naciente no captada de agua, pero que la construcción se ubica fuera del área de protección. Partiendo de lo anterior, el recurrente arguye que la prueba corrobora que en la propiedad existía al menos una naciente, que la edificación levantada se encontraba dentro de la zona de protección de ésta, y que la nomenclatura asignada a la naciente, que en principio fue 257 y 258, que luego se indica que en [Nombre8] aparece como la NAC-1189, no afecta ni incide en la acreditación del cuadro fáctico acusado e, incluso, las coordenadas geográficas, que son un dato que surge hasta la visita de SENARA, luego de que GEOTEC había realizado ya una visita al lugar y establecido sus coordenadas, tampoco inciden en los hechos, y ello obedece a un aspecto que el Tribunal no reparó en su análisis y tampoco valoró, como es la declaración de [Nombre10] , quien afirmó categóricamente que realizó una visita al lugar y ubica una naciente, que luego a ese mismo lugar fue con el perito del [Nombre11]., que también fue con el de SENARA, que en las trece ocasiones siempre bajó al mismo punto de afloramiento, por lo que es claro que la naciente que se ubica en el sitio como punto de referencia es la misma, y es la que determina que las construcciones realizadas se encuentran dentro de las 100 metros del área de protección.
Incluso, el informe de GEOTEC, se ubica la naciente 257 y establece que la misma es donde se origina la quebrada, dato que no había sido suministrado por la Municipalidad ni por el SINAC en su denuncia, pues en la denuncia solo se hace alusión a la existencia de la naciente, pero no al origen de la quebrada, aspecto que fue determinado por el Geólogo [Nombre6] en su informe, que no fue ponderado por el Tribunal, aunado a que en su informe se describe como figura 3.1 se ubica la naciente 257 como una naciente no captada y la más cercana al inmueble propiedad del imputado, incluso ubica el punto de la esquina de la casa, lo que al confrontarlo con el informe de ingeniería lleva a la conclusión de que se trata del mismo lugar de ubicación de la naciente, corroborándose que se encuentra dentro del área de protección de 100 metros, nada de lo cual fue valorado por el Tribunal. Señala que las declaraciones de [Nombre5] , [Nombre12] y [Nombre4] coinciden en ubicar el punto donde se da el afloramiento de aguas, que corresponde a la figura 3.1 del informe de GEOTEC, por lo que pese a existir pruebas de la existencia de la naciente en la misma ubicación, el Tribunal, de manera infundada, sostiene que existe una duda basada en una nomenclatura distintas en los informes de la Dirección de Aguas, pero sin haber analizado y confrontado los elementos probatorios que fueron evacuados tendientes a ubicar el cuerpo de agua denunciado por el SINAC.
Solicita la anulación del fallo y del juicio que lo antecedió, disponiéndose el reenvío para nueva sustanciación. Como segundo motivo del recurso interpuesto por la Procuraduría General de la República, se reclama falta de fundamentación intelectiva y errónea valoración de la prueba, con violación al principio de libertad probatoria en lo relacionado con la absolutoria de [Nombre7] por el delito de Infracción a la Ley Forestal, declarando sin lugar la acción civil resarcitoria. Señala que el Tribunal de Juicio absolvió por considerar que existió duda en cuanto a que el imputado hubiera actuado con dolo, lo que justificó la absolutoria penal y el rechazo de la acción civil resarcitoria. Luego de transcribir parte de los fundamentos del fallo, arguye que el Tribunal creyó la versión del acusado respecto a que para el año 2009 contrató a un arquitecto de apellido [Nombre9] para realizar los trámites y el uso de suelo, lo que bastó a los juzgadores para tener por demostrado que el señor [Nombre1] no se enteró de la advertencia municipal.
El apelante señala que en el expediente municipal consta el oficio PUCC US 707 2008 donde se le advierte al imputado sobre la existencia de dos nacientes de agua que cuentan con área de protección de 100 metros (que según la Ley Forestal está reservada a las nacientes permanentes), donde se especifica que cualquier desarrollo debe realizarse fuera de esa área, siendo éste el único documento de uso de suelo que fue extendido, pues no se solicitó ningún otro. Reprocha que el Tribunal no reparó en que el uso de suelo fue expedido en el año 2008, cuando el imputado todavía no había contratado al ingeniero [Nombre9] , pues dicha contratación se hace hasta agosto de 2009, como consta en el contrato de servicios profesionales visible a folio 32 del expediente municipal, lo que contradice la versión del imputado, pese a lo cual fue validada por el Tribunal. Agrega que en el expediente municipal consta un oficio 1321-1242-2009 extendido por el I.C.E. en fecha 23 de junio de 2009, donde se indica que en la propiedad donde ocurren los hechos existen líneas de distribución del servicio solicitado por el imputado, como también un documento de la Administración Tributaria de la Municipalidad de Grecia, emitido en esa misma fecha, donde a solicitud del justiciable se hace constar que éste se encontraba al día con el pago de los impuestos municipales, así como también el oficio RT-59-0000141231, en el cual el I.N.S. expide constancia a solicitud de [Nombre1] de la suscripción de una póliza de riesgos de trabajo para construcción.
Arguye el recurrente que estos documentos, que no fueron valorados por el Tribunal, acreditan que el imputado, antes de la contratación del ingeniero [Nombre9], hizo todos los trámites, incluso la solicitud de uso de suelos, pese a lo cual el Tribunal solo hace referencia al documento de uso de suelo extendido por la Municipalidad y derivan de dicha prueba que no es posible acreditar que el encartado tuviere conocimiento del contenido de éste, porque en su declaración señaló que contrató a una persona para que gestionara los permisos, contratación que se hizo un año después de que se solicita el permiso de uso de suelo. Agrega que según la declaración de [Nombre13] , estos documentos no iban dirigidos solo a profesionales, sino a los administrados para que conocieran las limitaciones sobre su propiedad, nada de lo cual fue analizado en sentencia. Reitera que en el expediente existe una declaración jurada sobre la existencia de la naciente no captada, documento que no es dirigido a la Municipalidad y que tiene como fecha de emisión el 14 de agosto, mismo día que se firma el contrato de servicios profesionales, cuestionándose el recurrente cómo pudo haber tenido conocimiento el ingeniero [Nombre9] de la existencia de una afectación de nacientes, si ese mismo día firmó el contrato.
Para el apelante la respuesta es que la solicitud de uso de suelos estaba en poder del imputado. Para el apelante no es verosímil que el imputado no tuviere conocimiento de documentos que fueron emitidos a solicitud suya y que guardan relación con una fuerte inversión económica que hizo desde el año 2007. Reprocha que tampoco fuese valorado el plano de la propiedad ofrecido con la querella, el cual indica que ésta tiene 109 metros de largo, por lo que, si el uso de suelo advertía que no se podía invadir el área de protección, esto dejaba muy poco espacio para una construcción, lo que hacía inviable cualquier desarrollo en dicho inmueble, pese a lo cual el imputado contrató al ingeniero [Nombre9] para desarrollar la obra. Reitera que el contrato con este último fue suscrito un año después de emitido el documento de uso de suelo, así como que el permiso de construcción fue emitido en un solo día por parte de la Municipalidad, nada de lo cual se analizó por el Tribunal y apuntaba al conocimiento que tenía el imputado de la existencia de nacientes.
Refiere que según la denuncia del SINAC y la declaración de [Nombre14] , la obra fue clausurada el 18 de noviembre por haber afectación a la naciente 257, resultando que el imputado contrató al ingeniero [Nombre6] que hace el informe de GEOTEC, el cual fue remitido a la Municipalidad sin que éste fuese revisado por analizado por alguna entidad competente. No obstante, no existe ninguna resolución de levantamiento de orden de clausura por parte de la Municipalidad y el imputado, pese a las nuevas advertencias, terminó la obra, por lo que no lleva razón el Tribunal en sus apreciaciones, puesto que la prueba apunta a que el justiciable terminó la construcción de manera ilegítima, lo que fue confirmado por los testigos [Nombre13] y [Nombre14] , mismas que no fueron correctamente valoradas por el Tribunal de Juicio, pues derivó erróneamente la conclusión de que éstos le otorgaron credibilidad al imputado.
Agrega que, al ser indagado, el imputado corrió a vender la propiedad sin advertir a los compradores de que tenía un proceso penal en su contra, lo que refuerza la existencia del dolo. Considera insostenible el argumento de que hubo error de tipo, porque no sabía del carácter permanente de las nacientes, porque en las advertencias que le hizo la Municipalidad claramente se indica que existía una zona de retiro de 100 metros, que la ley solo contempla para las nacientes permanentes, e, incluso, esta advertencia fue reiterada por el SINAC al clausurar la obra, pese a lo cual finalizó la construcción. Solicita se anule la sentencia y el debate que lo precedió, ordenándose nuevo juicio. Por contener reclamos reiterativos y conexos, los tres anteriores motivos se conocen en un mismo considerando, declarándose sin lugar: Contrario a lo que aluden los apelantes, luego de revisar integralmente el fallo y el contenido del expediente, lo que observa es que durante plenario fueron incorporados dos dictámenes técnicos -ofrecidos por la parte acusadora y la defensa- cuyas conclusiones se contraponen y excluyen entre sí.
Primeramente, el informe pericial de la empresa GEOTEC, refrendado por el geólogo [Nombre6] [Nombre6] (cf. folios 100 a 105), de acuerdo con el cual el cuerpo de agua objeto de estudio, constituye el flujo base de la Quebrada Flores y forma parte de ésta, de manera que no es una naciente permanente en los términos del inciso a) del artículo 33 de la Ley Forestal. Por otra parte, el informe DIGH-UGH-OG-066-2012, elaborado por el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), suscrito por el geólogo [Nombre4] [Nombre4] y la ingeniera agrónoma [Nombre15] García Serrano (cf. folios 133 a 138), donde se concluye que dicho afloramiento corresponde a una naciente de carácter permanente. Ambos peritajes hacen referencia al mismo cuerpo de agua y coinciden en que se encuentra a una distancia inferior a 100 metros de la casa de habitación construida por el imputado [Nombre1] .
Ahora bien, para esta Cámara de Apelación, no resulta atendible el reclamo de que el Tribunal de Juicio nunca debió invocar, como parte de sus fundamentos, el estudio elaborado por FUNDEVI y la Escuela Centroamericana de Geología de la Universidad de Costa Rica (UCR), porque éste no fue incorporado en juicio. En primer lugar, la existencia de dicho estudio geológico nunca ha sido cuestionada, y, en segundo lugar, porque tanto en los informes de [Nombre8] como de GEOTEC y de la Dirección de Aguas, toman datos de interés de dicho estudio para sustentar sus conclusiones, favor y en contra de la existencia de una naciente permanente. De hecho, se observa que en el oficio DIGH-UGH-OF-066-2012 -citado por los apelantes en apoyo de su tesis- expresamente se cita este mismo estudio del 2007 elaborado por FUNDEVI y UCR, para sostener que el sitio denunciado se encontraba en una zona de baja a media vulnerabilidad a la contaminación para el acuífero Colima y de moderada a alta recarga acuífera (cf. folio 135), dato que justamente constituye su punto de partida para sostener que el sitio denunciado constituye una naciente permanente que representa la existencia de un acuífero que se encuentra aflorando en la superficie, puesto que el estudio de FUNDEVI y la UCR indica que era posible encontrar en la zona un sistema acuífero multicapas, donde el más cercano a la superficie era el denominado Sistema Secundario Colima, conformado por tobas y lavas, lo cual respaldaba técnicamente la existencia de un acuífero en el lugar señalado (cf. folio 137).
Como puede verse, el propio informe del [Nombre8] se apoya en datos recopilados por FUNDEVI y la UCR, de manera que cuestionar la existencia y contenido de este estudio, tendría como consecuencia el poner en entredicho todos los peritajes de cargo que los recurrentes citan en apoyo de sus alegatos. En debate, el perito de la defensa utilizó este mismo estudio para afirmar el error en que incurrió SENARE, puesto que el referido manto acuífero se encontraba en un lugar distinto. En lo que respecta al reclamo de que en el informe de GEOTEC no existe un estudio del nivel freático, los apelantes soslayan las explicaciones que en juicio brindó el geólogo Rojas Castro, quien al respecto indicó que cuando él presentó su informe, no existía el presente proceso penal y, por consiguiente, tampoco el informe DIGH-UGH-OG-066-2012 que, varios años después, venía a cuestionar las conclusiones de su pericia, por lo que entonces, durante el debate, fue necesario para él ampliar varios puntos de ésta.
Para este Tribunal de alzada, la explicación del geólogo Rojas Castro resulta razonable, amén de que las partes tuvieron oportunidad de interrogarlo de manera exhaustiva. Pues bien, refiriéndose a los cuestionamientos que realizó el [Nombre8] al estudio efectuado por GEOTEC, el perito [Nombre6] señaló: “Las condiciones geológicas no cambian lo que si cambian es las condiciones de los niveles de aguas subterráneas Hidrogeológicas. Lo que significa que en algunas épocas del año que hay recarga cuando hay agua se infiltra el nivel sube, en algunos manantiales cuando ese nivel sube esta brotando en verano ese nivel baja ese es el cambio que se da cuando es agua subterránea. Ese es el criterio para decir que es permanente o no cuando el nivel freático sube y brota, la condición es que exista agua subterránea, si una institución califica de manantial una salida de agua debe de demostrar que se trata de aguas subterráneas, ese requisito técnico que se obliga aquí siempre, se nos exige a los que hacemos estudios para trabajar en ese tema y cuando las instituciones piden que califica un punto como manantial y donde está el nivel del agua subterránea no hay recursos para hacerlo y eso entonces queda a criterio de la persona y aplica un radio de protección que afecta a los administrados.
Si no se tiene el estudio no podría decirse que hay un manantial. En realidad no conozco quien o cual institución es quien determina que es naciente o no, solo conozco la instancia del Contencioso administrativo, la municipalidad apoyo mi criterio pero en el 2007 contrato un estudio a FUNDEVI de la Universidad de Costa Rica que vende servicios usando el sello UCR, en ese mismo año existió una tesis maestría de un estudio Geogeológico del Cantón de Rio Cuarto de Grecia o occidental. La municipalidad sometió posteriormente la aprobación de [Nombre8] hasta donde yo entiendo la municipalidad invierte 27 millones de colones es una herramienta de trabajo en ese estudio que es mencionado en la nota de Senara, allí hay líneas isofreáticas es un mapa de como esta la superficie del agua en un acuífero, ellos determinan tres acuíferos y el más superficial es lavas unidad San Pedro, esta ese mapa hecho en el estudio y si en aquel momento yo hago el estudio y la municipalidad me dice que en su estudio no hay manantial esta en contraposición que la masa freática esta arriba, yo no sé si la municipalidad utilizo o no ese estudio para la toma de decisiones, en este momento no se utiliza ese estudio.
Ese mapa de isofreáticas el mismo que realizo la UCR y aprobó el [Nombre8] dice que en ese sitio de San Isidro la superficie esta 70 metros por debajo de donde dice que hay un manantial y ese estudio vienen a corroborar mi estudio y si la municipalidad usa ese estudio como instrumento para toma de decisiones hizo la correcto, en el estudio de ellos dice que esta por 70 metros por debajo donde hay un manantial, si indica que para que exista manantial debe de haber superficie freática. El mapa presenta es tomado la UCR es igual que realizado por tesis de [Nombre16] la municipalidad tenia ese estudio y ese mapa de como es el agua subterránea en el sitio yo marque en rojo. El [Nombre8] en el documento que realizo menciona el estudio de Fundevi y lo uso como argumento principal para invalidar mi trabajo. Lo cierto es que el estudio Fundevi UCR valida mi trabajo. Si la municipalidad valido y dio por correcto mi trabajo la municipalidad tenia una herramienta técnica que era el estudio que había contratado 4 años antes con la UCR.
Ese mapa esta en un estudio como argumento principal por el [Nombre8] que tiene la forma de como es la superficie de agua en el sitio. Muestra esquema - causa de la Quebrada Flores el sitio donde esta poniendo manantial es a [Dirección3] a nivel de mar. Lineas que unen punto de igual elevación y dice que esta a nivel 1100 y las flechas que indican a donde fluye el agua subterránea en el sector es como 1220 por ello sabemos que el agua subterránea es a elevación 1220 si sacamos diferencia entre el punto del supuesto manantial y el punto donde esta nivel agua subterránea hay una diferencia de 70 metros eso quiere decir que el agua subterránea esta por debajo 70 metros. Las guías técnicas nacionales del 2004 esta como reglamento publicada en la gaceta en la cual define que es acuífero, dice también que es agua subterránea, indica cual es y que esta por debajo del nivel freático, la definición naciente donde la superficie del terreno corta el nivel freático y allí brota el agua pero en el lugar la superficie del terreno no corta el terreno, no cumple esa condición no lo corte no cumple la definición de manantial y ese mapa fue emitido por el mismo criterio del SENARA.
En el documento de [Nombre8] dice que el acuífero aflora en superficie y el estudio elaborado Fundevi es posible encontrar -lee -el argumento principal de [Nombre8] para descalificar mi trabajo, es cierto eso o no es falso por cuanto Colima no esta en el sitio que están diciendo, no se si no se tomaron la molestia de leer el documento que ellos firmaron, no puede indicarse que all í esta colima en San Isidro por que cualquier Geólogo que conozca la Geologia de Grecia sabe que no es cierto, el argumento principal técnico que mencionan para invalidar mi trabajo es falso […] Hallazgos característicos que se deben de observar para saber si hay naciente, en algunos casos por el tipo de rocas que hay son lavas fracturadas y el agua brota en forma espontánea y en otros casos es difícil por la sola inspección visual, se debe de revisar los estudios que existan para esa determinación. Naciente tiene que haber afluencia de agua subterránea sin duda características básica salvo que exista artesianismo agua en presión por cuanto hay agua y brota por algún efecto.
En el caso el rio Rosales en Grecia en verano se ve el agua brotar del fondo del rio claramente uno se da cuenta que hay brote y que hay artesianismo, y en otros casos muy excepcionales como Ojo de agua que esta al frente de una colada de agua. Con solo una inspección es difícil. Otra característica es que sea un punto fijo una naciente o manantial no puede estar brotando y al mes cambiar porque debe de haber una estructura geológica puede ser una fractura que hace que la descarga de agua brote, es requisito que sea un punto fijo que siempre este allí. Que uno pueda reconocer el acuífero lo que contienen el agua subterránea, es decir en algunos manantiales en Grecia las lavas de la unidad San Pedro en esos frente de lavas lo reconoce claramente el acuífero. No se puede encontrar en un lugar de terrenos arcillosos, el acuífero debe de desarrollarse en un medio permeable. En roca como lava si es posible encontrar naciente en depósitos como hay aquí no, el agua sale y empuja hacia adelante y produce una inestabilidad en esa ladera y si uno ve fractura de descompresión hay problemas de inestabilidad en el sitio.
Folio 105 se indica que se comprobó en el sitio que el manantial no es único en ese momento creo que era el 257 que insisto que ese bloque estaba definido como manantial yo lo que hice fue ubicar lo que el SINAC decía y yo ubico varias salidas de agua y eso era porque había salida de agua por la quebrada y bloque caídos. Yo lo que hago en ese documento es usar la información del SINAC y decirle que si uds están considerando pero no lo puse así que hay aquí un montón de manantiales lo que forma es una quebrada póngale la protección de la Quebrada, el tema en ese momento era muy básico, no era un informe para entrar en controversia ni hacer argumentación en contra de la hipótesis del SINAC. En este momento si uno va a [Nombre8] a realizar estudios de estos le pide una perforación. Conclusión cuando yo digo que forma parte intrínseca de la quebrada flores si ese es el planteamiento que esta asiendo el SINAC debe de entender que es flujo base si existe linealidad de la naciente, allí sigue por la quebrada.
Parte intrínseca es que están allí como flujo de la quebrada. Yo puse los manantiales con las coordenadas estaban como a diez metros de ese lote. Yo me concentre en el problema que era el 257. La condición del sitio no permite realizar una medición es en el puro cauce de la quebrada. Es muy difícil no se puede hacer medición por la caída de material. El brote de agua viene de arriba en mi opinión toda el agua cae de esa zona, la carretera que va de Grecia a San Isidro todo lo que esta al oeste va a esa quebrada que escurren allí. Es una zona complicada por inestabilidad. Si algo tapa la salida de agua en la foto izquierda el agua se va por otro lado. Folio 100 a [Nombre17] se le dirige el informe porque [Nombre7] me lo pidió que lo dirigiera él. El estudio fue porque la Municipalidad se lo pidió. El estudio de suelo es para determinar capacidad de soporte y asentamiento de laderas que se hace en campo, en campo de la zootecnia es para obra civil.
El estudio del Uso de Suelo no existe aquí la municipalidad estaba pidiendo pero no se hace un estudio para eso, lo que era es básicamente que el administrado debía de contratar a un ingeniero o arquitecto para presentar a la municipalidad. Para determinar un cuerpo de agua es un estudio hidrogeológico y el de uso de suelo es para ingeniería y si los he realizado”. Como puede verse, la tesis sostenida por el perito de la defensa es que las conclusiones del estudio de GEOTEC son correctas, no así las del SENARA, en primer lugar, porque de acuerdo con el estudio de FUNDEVI y la UCR, no hay mantos acuíferos en la zona afectada, toda vez que el manto de Colima se ubica en un sector totalmente distinto y alejado, de ahí entonces dicho estudio, lejos de contradecir sus conclusiones, más bien las avalaba. En segundo lugar, refiere que el documento de FUNDEVI y la UCR ubica el nivel freático en el área de interés en 70 metros, lo que resulta incompatible con las afirmaciones de SENARA, de manera que la única forma de establecer, con certeza, que el cuerpo de agua que se encuentra cerca de la vivienda que construyó el imputado era una naciente permanente, era a través de un estudio hidrogeológico.
Pues bien, si el Ministerio Público y la Procuraduría General de la República pretendían la condenatoria del imputado por el delito de Invasión a Área Protegida (art. 58 inciso primero de la Ley Forestal), debían rebatir la tesis defensiva. Y eso fue justamente lo que no consiguieron en el sub júdice, puesto que, como se verá más adelante, en sentencia se explica que tanto los testimonios de [Nombre4] como de [Nombre6] fueron amplios y claros, impresionando sinceridad y ausencia de intencionalidad de favorecer o perjudicar al imputado, razón por la cual no había razones para restarles credibilidad. Por ello, el Tribunal de Juicio decidió solicitar un tercer criterio, esta vez a la Dirección de Aguas, que de acuerdo con el oficio del SINAC OG-1212-2017 del 25 de agosto de 2017 (cf. folios 646 y 647), es el ente competente para caracterizar un cuerpo de agua en caso de duda, en procura del esclarecimiento definitivo de la naturaleza del sitio donde aflora el agua, con el resultado de que este último departamento tampoco pudo dar una respuesta definitiva, razón por la cual se impuso la absolutoria del imputado en aplicación del principio in dubio pro reo.
En efecto, llama la atención que tanto en el recurso del Ministerio Público como en el de la Procuraduría General de la República, se exponen en forma sesgada los razonamientos del Tribunal para sustentar la duda. Incluso, en ambos recursos se pretende hacer transcripciones de los fundamentos del fallo, más, sin embargo, a la hora de cotejarlas con la sentencia, se detecta que éstas estaban incompletas, pues se omite consignar argumentos y afirmaciones esenciales del órgano de instancia para justificar la duda. Con respecto a este tópico, los juzgadores -en síntesis- explicaron que en este caso no solo existía duda en cuanto a las nomenclaturas utilizadas por las diferentes instituciones involucradas en el resguardo del recurso hídrico (SINAC, [Nombre8] y la Dirección de Aguas), así como dudas en cuanto a la ubicación georeferencial de la misma, sino además dudas en cuanto a si el afluente con las características indicadas por SINAC y [Nombre8] se trataba de una “naciente”.
Señalan que los acusadores hablan de la existencia de dos nacientes en el sitio, la 257 y 258, basándose en el informe del SINAC practicado por [Nombre5] y [Nombre18] , el cual reporta que la construcción realizada por el imputado se ubicaba a [Dirección4]. 5 metros del afluente que ellos identifican como naciente, cuya ubicación geográfica, según coordenadas de éste, es 233267 horizontales y verticales 506347, en tanto que en el informe DIGH-1092-11 del SENARE se reporta a la fiscalía que, para el 17 de noviembre del 2011, revisada la base de datos de dicha institución en una radio de 2000 metros a la redonda donde se ubica la propiedad del encartado, se localiza una naciente identificada como la NAC 1189, situada a 82 metros del sitio. No obstante -prosiguen los juzgadores- una vez realizado el estudio de campo del SENARA, mediante el informe DIGH-UGH-OF-066-2012, los profesionales que efectuaron la inspección refieren la localización de una naciente ubicada ahora en las coordenadas [Dirección5] , concluyendo que se trata de la NAC 1189, registrada de forma previa según la base de datos de dicha entidad, así como que la distancia entre la infraestructura y el afloramiento es de 48 metros, de manera que ambas instituciones ni siquiera tenían claridad en cuanto a la nomenclatura con que identifican el cuerpo de agua, brindaron distintas coordenadas y distancias entre la ubicación del afluente con respecto a la vivienda.
Esta misma situación -explican los juzgadores- ocurre con el oficio de la Dirección de Aguas DA-UHTPCOSJ-2262-2021, que fue solicitado por el Tribunal A quo, en el cual no reconoce ninguna de estas nomenclaturas y se indica que, si bien bajo el oficio DA-UHTPCOSR-0240-2019, esa institución referenció una afluente como naciente, ello en las coordenadas latitud [Dirección6] y longitud [Dirección7], y, para poder concluir certeramente que se trata del mismo afluente consultado o bien se trata de dos nacientes independientes, sería necesario realizar la inspección en campo (Esto último se omite en las transcripciones de ambos recursos). Continúa explicando el órgano de instancia que, en debate, los funcionarios del SINAC, [Nombre5] y [Nombre18] , quienes inicialmente dijeron que el cuerpo de agua correspondía a una naciente de carácter permanente, caracterización que se debía a que el agua aflora en el lugar en todas las épocas del año y que, ante las visitas realizadas por ellos en diferentes épocas a lo largo de la investigación, era claro que se trataba de una naciente permanente.
Sin embargo, ambos testigos dejaron claro que, a pesar de la denominación dada por el SINAC, los autorizados para tal efecto lo era la Dirección de Aguas, refiriendo el testigo [Nombre18] que ellos ubican la naciente y piden criterio a la Dirección de Aguas, pues ellos no pueden decir si la naciente es permanente o no, sino que hacen inspección y si encuentran afloramiento lo reportan a la Dirección Aguas o al SENARA, pero no pueden dar criterio si el afloramiento es permanente, de manera que actúan según el criterio de estas entidades (Esto se omite en la transcripciones de los recursos). Señalan los juzgadores que se tuvo una visita de campo realizada por el [Nombre8] con ocasión de este proceso, resultando que [Nombre4] explicó en debate que si bien él no bajó hasta el afluente, con la fotografía tomada por su compañera [Nombre15], determinó que el afloramiento de agua se trataba de una naciente, por cuanto en la fotografía se veía claramente salida del agua subterránea y era coherente a lo que [Nombre15] y los compañeros del SINAC dicen, pues había roca fracturada, aguas saliendo de la roca y que origina la quebrada que es la que se ve en la parte de arriba.
Refirió el testigo que, de acuerdo al concepto de nacientes, eso calza que es afloramiento de agua subterránea a través de fracturación de la roca, y, como ya tenían el levantamiento del compañero del SINAC, buscó en la base de datos del archivo nacional de pozos y manantiales, donde aparecen pozos cercanos y por la topografía de la zona son profundos, pero todos reportan nivel de agua subterráneo albergado en rocas de origen volcánico, igual que el afloramiento donde están las fracturas donde sale el agua lo que origina la naciente. Indicó el deponente que, al haber pozos con nivel de agua registrado es que hay un acuífero, si no hay un acuífero en ese sector no se hubiera encontrado agua, y a partir de esa información [Nombre8] indica que se trata de una naciente permanente, porque se está visitando en la época más crítica de la época seca. Explicó también el testigo que cuando hablaba de un flujo de agua que aumenta progresivamente, eso era agua subterránea que estaba aflorando en superficie, que quien aportaba el agua es el agua subterránea, y de donde aflora de un acuífero y éste da resultado una naciente (Esta parte se omite en la transcripción de los recursos).
Pues bien, con fundamento en lo afirmado por el testigo [Nombre4] , el Tribunal concluyó que ya no solo se hacía necesario que el afluente poseyera agua en todas las épocas del año para su caracterización, sino que además era necesario acreditar que el flujo de agua provenía de aguas subterráneas, lo que coincidía con lo indicado por el perito [Nombre6] , quien refirió que ese era el criterio para decir que la naciente era permanente o no, esto es, cuando el nivel freático sube y brota; la condición es que exista agua subterránea, de manera que si una institución califica de manantial una salida de agua, debía de demostrar que se trata de aguas subterráneas, requisito técnico que se obliga en el país siempre y que se exige a quienes realizan estudios para trabajar en ese tema. Señala el Tribunal de Juicio que en este punto ambos peritos difieren, por cuanto para [Nombre4] , a pesar de que en el lugar no se realiza una perforación para determinar el nivel de agua subterránea, éste concluye que ante la existencia de pozos en el sitio y que los mismos ya fueron referenciados por [Nombre8] y por la misma Dirección de Aguas, conlleva a concluir que el manto acuífero se encuentra a nivel de superficie, máxime que de la carta hidrográfica se reporta que en el sitio el manto acuífero que afloraba es el de Colima.
Por su parte, para el geólogo Rojas Castro esta afirmación no podía ser cierta ya, que conforme a estudios científicos realizados por el FUNDEVI y por el laboratorio de la UCR, el nivel isofreático en la zona estaba por debajo de los setenta metros, y que en consecuencia tal afloramiento no se podía relacionar con el manto acuífero Colima, el cual se encuentra ubicado en otro lugar y no en el distrito de San Isidro, lugar donde se encuentra la propiedad del encartado. Refieren los juzgadores que, de acuerdo con la exposición de este perito, para determinar si existe naciente debía haber un estudio hidrogeológico, pues en la inspección solo se ve una salida agua, por lo que el estudio debe de conocer el origen del agua, de dónde vienen y que características, resultando que entidad competente para llevar a cabo el citado estudio era la Dirección de Aguas. El Tribunal explica entonces que, por esta razón, a pesar de haber concluido el debate, y en razón de la trascendencia de dilucidar certeramente si se encontraban frente una naciente, se realizó la consulta a la Dirección de Aguas y, si bien dicha entidad refirió que en el 2019 se hizo una visita en el sitio en el cual se referenció la existencia de una naciente sin nombre, no podían, con los elementos que se le hicieron llegar, determinar que en las coordenadas indicadas el afluente existente en dicha zona se trate de una naciente, ya que para ello se hace necesario un estudio de la zona.
Por lo anterior, a criterio del Tribunal de mérito, para acoger el criterio rendido por [Nombre8] y por el testigo [Nombre4], como pretendía la parte acusadora, la única manera de fundamentar la categoría de la naciente sería apelando meramente a un criterio de autoridad y señalar que se trata de una naciente porque el [Nombre8] y la Dirección de Agua también lo refirieron, pero es una explicación clara de cómo llegaron a esa conclusión, puesto que para ambas instituciones la observación en el sitio y el hecho de que aflore agua todo el año, ya sería suficiente para determinar que es una naciente, pero lejos de esa observación, que parece bastante empírica y poco científica, cuando se cuestiona el método, ambas instituciones se quedan cortas y no analizan la evidencia existente, o bien dicen que para dar respuesta a lo peticionado se requería un estudio mayor, dejando nuevamente en el aire la posibilidad de confrontar esas valoraciones empíricas con el método científico.
Aclara el cuerpo juzgador que no buscó cuestionar por mero capricho lo dictaminado por la Dirección de Aguas, o lo dicho por el representante del SENARA, sino que existía un aspecto normativo que claramente define qué es una naciente. Al respecto -prosigue el A quo- la Dirección de Aguas indicó que naciente es el flujo de agua subterránea que aflora en la superficie debido a cambios topográficos, zonas preferenciales, rasgos geológicos-estructurales como fallas, o cambios en la conductividad hidráulica, fracturas o discontinuidades. Razonan los jueces que, conforme a lo indicado por la propia Dirección de Aguas, para que exista naciente, es porque esa salida de agua necesariamente se tiene que relacionar con un manto acuífero, y que ésta sea el punto de afloramiento, pero sucede que en esta causa eso no se pudo determinar, considerando que el estudio del FUNDEVI, que es un documento de carácter público y usado como referencia por el [Nombre8] y por el informe de GEOTEC, señala diferentes niveles de profundidad de las aguas en el sitio que distan mucho de la altura en relación al nivel del mar en el que se ubicó el punto en estudio.
Argumentan los jueces que, aunado a lo anterior, el mapa isofreático del [Nombre8] para la zona de Alajuela, que también consta en su página de Internet, hace ver que el acuífero Colima está sumamente alejado de la zona de San Isidro de Grecia, y ahí lo que hay, según dicho mapa, son curvas isofreáticas y nadie había podido contestar al Tribunal si el afloramiento en estudio tenía o no relación con estas curvas, o bien con cuál manto acuífero en particular y a qué profundidad se ubica. Continúan explicando los juzgadores que, que aunque podría decirse que se requería una inspección de campo para dar esa respuesta, la misma, a su vez es más científica y se basa en datos ya recopilados en el sitio como la profundidad de pozos ya excavados en la zona o la información existente en diferentes entidades estatales como la Universidad de Costa Rica, que permitan establecer a que nivel se encuentra en el sitio el nivel del agua subterránea y si esto coincide con la ubicación del afloramiento, no simplemente darlo por sentado sin indicar mayor fundamento.
Concluye el A quo que, por estas razones, no podía señalar que en el sitio existiese con claridad una naciente y que esa sea ésta de carácter permanente. Pues bien, valorados estos razonamientos, en contraste con el contenido del expediente, a criterio de este Tribunal de alzada los fundamentos del fallo respetan las reglas de la crítica racional y se ajustan al material probatorio. Lo primero a indicar, es que esta Cámara no encuentra excesiva la calificación que hizo el Tribunal de Juicio de los informes del SENARE y de la Dirección de Aguas como empíricas. La determinación de si las afirmaciones conclusivas de un informe pueden ser catalogadas como científicas, no depende exclusivamente de la jerarquía o prestigio que pueda gozar la entidad que lo emite, como erróneamente asumen los apelantes (pues ello implica caer en una falacia de autoridad), sino más bien si dicha conclusión es resultado de la aplicación del método científico para el examen del caso concreto.
De ahí que no resulta aceptable la queja de la Procuraduría, pues la mera acumulación material de documentos emitidos por distintas instituciones (SINAC, SENARE y Dirección de Aguas), donde se refiere que en el sitio había una naciente permanente, por sí sola no bastaría para adquirir certeza al respecto, si tal afirmación no encuentra respaldo en estudios científicos contundentes, de manera que desvirtúan, sin lugar a duda la prueba de descargo. En efecto, revisado el informe DIGH-UGH-OF-066-2012, observa este Tribunal que el geólogo [Nombre4] -a diferencia del geólogo [Nombre6] - consideró riesgoso el descenso hacia el lugar donde estaba la salida de agua, por lo que no realizó un análisis in situ del afloramiento, sino a través de una fotografía. Y como bien se explica en sentencia, el propio perito [Nombre4] confirmó en juicio que justamente lo que caracterizaba un afloramiento como naciente permanente, es que su fuente sea un caudal de aguas subterráneas, que responden a mantos acuíferos.
Luego, no es cierto entonces que el cuerpo juzgador omitió valorar los criterios técnicos de [Nombre8] y lo expuesto en juicio por el perito [Nombre4] . Por el contrario, lleva razón el Tribunal de Juicio en que no basta que un informe simplemente indique que se observa una salida de agua, que tiene algunas características que en principio pueden ser compatibles con las nacientes permanentes (v. gr. rompimiento de rocas), si no se confirma la procedencia de esta agua, por lo que tampoco se aprecia yerro alguno en el razonamiento analítico de los juzgadores, cuando validaron los cuestionamientos formulados por el perito [Nombre6] a la prueba de cargo. Por ende, no lleva razón la Procuraduría cuando critica las conclusiones del peritaje de GEOTEC, puesto que, independientemente que éste refiera la presencia de varios manantiales, en debate el perito [Nombre6] explicó la procedencia de estas aguas, descartando que se tratase de aguas subterráneas que dieran lugar a una naciente en los términos del artículo 33 de la Ley Forestal, de ahí que no se aprecia la pretendida contradicción, toda vez que del documento no se infiere que estos afloramientos tuvieren su origen en el manto acuífero Colima (como sí consideró SENARA), ni en manantiales subterráneos.
Tampoco es atendible el reclamo de que es ilógico que, según lo indicado en el propio informe de GEOTEC, hubiese un afloramiento de agua de 0.5 a 1 litro por segundo, si no existiese alimentación de aguas subterráneas. Este alegato desconoce la explicación que al respecto propuso el perito [Nombre6] : “En el sector hay descargas de aguas residuales, lluvias, todas esas aguas van al sitio que se definió como naciente, los tanques sépticos con sus sistemas de drenaje pero el agua baja y va al subsuelo y en algún lado sale y esto es en la parte mas baja. En la zona se observa agua descargando esto fue en el 2012 allí han existido deslizamientos, en el informe de [Nombre8] existen indicaciones de grietas, en el lugar por el relieve se van creando grietas en lo que se llama cara libre y la descompresión siempre se da hacia la ladera, en la ladera el agua corre y el origen de esa agua son esas y cuando llega a ese lugar aun en verano el agua siempre fluye pero ya sabemos que el agua es la que corre en el lugar y no puede ser subterránea porque esta a 70 metros por debajo de la superficie.
En en el informe de Sinac establece una serie de nacientes 257, 258 porque alli cae agua por todo lado, pero en el Sinac aparece en el mapa una naciente NAC 1189 el numero CED2 A es un pozo que fue confeccionado es lo que se denomina aguas captadas, no se si eso es naciente o aguas captadas y se utilizaban para agricultura pero ya no esta y ese punto esta a 180 metros de la casa así esta en la base de datos. El [Nombre8] indica que la Nac 1189 es el motivo de debate y la colocan en la zona verde que fue deforestada dentro de la propiedad que tenia [Nombre7] y la esta corriendo a cien metros, pero allí es la parte arriba y allí es zacate y es una tubería que recoge las aguas de la calle y discurren las aguas pluviales, es un cambio estuvo en un lugar estuvo consecionada y ahora la colocan en otro lugar”. (Copia textual) Como puede verse, la duda que invoca el Tribunal de Juicio tiene fundamento probatorio.
Los apelantes no logran refutar los argumentos del Tribunal y, en su lugar, sus alegatos se circunscriben a que, si en el lugar investigado había un afloramiento, en invierno y verano, necesariamente su fuente de alimentación eran aguas subterráneas. Pero en un caso tan particular como el que aquí nos ocupa, sin un estudio hidrogeológico que así lo confirme, ello se puede afirmar como mero indicio de un naciente permanente, pero no con la certeza que requiere la aplicación de la ley penal. Contrario a lo que se afirma en los motivos, el órgano de instancia hace ver en sentencia que, según la tesis sostenida por el geólogo Rafael Matamoros, justamente con base en el propio estudio de FUNDEVI y la UCR, las aguas superficiales a que hace referencia SENARE vendrían del manto acuífero de Colima, pero según el mapa isofreático del [Nombre8] para la zona de Alajuela, que también consta en su página de Internet, el acuífero Colima está sumamente alejado de la zona de San Isidro de Grecia, y ahí lo que hay, según dicho mapa, son curvas isofreáticas, sin que nadie haya podido contestar al Tribunal si el afloramiento en estudio tenía o no relación con estas curvas.
Entonces no es cierto, como lo afirma la Procuraduría, que el A quo se limitó a citar lo depuesto por el perito [Nombre4] , sin analizar su contenido, pues aquí se aprecia un análisis intelectivo de la prueba de cargo. Por las mismas razones arriba expuestas, lleva razón el Tribunal de Juicio al señalar que el oficio de la Dirección de Aguas DA-UHTPCOSR-0240-2019 (cf. folios 924 a 929), no agrega ninguna información de calidad adicional a lo referido por el SENARA, en el sentido de que la naciente se cataloga como permanente, básicamente, porque mantiene su caudal en verano (cf. folio 926), pero dicho informe tampoco refiere que existiese estudio hidrogeológico que confirme que la fuente fuese aguas subterráneas. Por ende, no se puede tachar como incorrecta la afirmación del Tribunal de Juicio respecto a que se trata de un criterio predominantemente empírico. Se le pidió por parte del órgano sentenciador a la Dirección de Aguas analizar el estudio Hidrogeológico Integral en el sector occidental del cantón de Grecia, No. 113-A5-402, que existía en la página de la Municipalidad de Grecia y era información de carácter público, así como el mapa hidrogeológico de SENARA, que también se encontraba en su página web; le solicitó también delimitar claramente cuáles acuíferos eran los que se encontraban en la zona de estudio y, de encontrarse por debajo de dicha zona, señalara cuál era su profundidad y si tenían relación con el afloramiento de estudio, así como determinar si en el sitio existían curvas isofreáticas y cuál relación podían tener con el afloramiento en estudio.
La respuesta de la Dirección en el oficio DA-UHTPCOSJ-2262-2021, fue que el análisis del estudio hidrogeológico no se había hecho y a fin de contemplarlo para un nuevo dictamen era requerido su conocimiento por parte de uno de sus geólogos, y la emisión del criterio implicaría el análisis de todos los insumos mencionados, sí como inspección de campo en la época de menor precipitación en la zona de Grecia (verano 2022), en tanto que el establecimiento de los mantos acuíferos también requeriría un estudio de la zona (cf. folio 921). Como puede verse, tomando en cuenta que, específicamente en el caso de estudio, entre el perito de cargo y descargo existió desacuerdo respecto a la presencia de mantos acuíferos en la zona donde se encontraba el afloramiento estudiado, así como la existencia de caudales subterráneos que lo alimentaran, factor esencial para catalogarlo como naciente permanente, el cuerpo juzgador decidió acudir a la Dirección de Aguas puesto que, como lo confirmó esta última en el propio oficio DA-UHTPCOSJ-2262-2021, según el decreto 35669-MINAET, la potestad de dictaminar cuerpos de agua le está dada únicamente a la Dirección de Agua.
Sin embargo, la respuesta que se obtiene es que no se ha realizado un estudio hidrogeológico y que sería necesaria una visita de campo en el verano de 2022. En consecuencia, no lleva razón la Procuraduría cuando sostiene que dicho oficio aclara las dudas que llevaron a la aplicación del principio in dubio pro reo en este caso concreto. Asimismo, resulta inaceptable el argumento de que se le debe restar credibilidad al perito [Nombre6] , porque en un proceso totalmente ajeno a la presente causa, se le consideró complaciente. Ello implicaría que el Tribunal de Juicio tuviese que renunciar a la sana crítica racional, para aplicar criterios de prueba tasada. Por ello, independientemente de que los apelantes consideren cuestionables las afirmaciones del informe GEOTEC acerca de que el afloramiento estudiado se alimenta de aguas pluviales, ello no basta para sustentar una condenatoria, porque como bien lo explica el Tribunal de Juicio, correspondía a la parte acusadora demostrar, con certeza, que las aguas que alimentaban el afloramiento en el terreno del imputado, provenía de caudales subterráneos alimentados por mantos acuíferos, cosa que nunca hicieron, puesto que, inexplicablemente, desde la fase de investigación nunca solicitaron los estudios respectivos a la Dirección de Aguas del MINAET, hasta que dicha prueba fue requerida -de oficio- por el Tribunal de Juicio.
Por otra parte, en lo que respecta a los reclamos de los apelantes sobre la pretendida falta de fundamentación sobre la duda en cuanto a la identidad y ubicación del afloramiento, nuevamente se observa que los apelantes citan de manera fragmentada los razonamientos del Tribunal. En efecto, al transcribir el razonamiento completo del cuerpo juzgador, se tiene que los juzgadores argumentaron lo siguiente: “[…] si bien el oficio 199-11-2011 de folios 74 a 75 y su ampliación de folios 122 a 126 del Servicio Nacional de Aguas Subterráneas, Riego y Advenimiento de forma preliminar informa que realizado un estudio preliminar en la base de datos que cuenta dicha institución, se referencia que dentro del radio de 2000 metros a la redonda de las coordenadas indicadas por la fiscalía en su solicitud, esta reportada la existencia de 12 pozos registrados, 2 ilegales y 17 nacientes y que la naciente más cercana es la por ellos identificada como NAC 1189, misma que según se indica en el informe preliminar se encuentra a 82 metros del sitio.
Ya para la ampliación que fue llevada a cabo por los funcionarios [Nombre15] García y Rafael Matamoros, estos funcionarios concluyen que la afloramiento de agua que existe en el sitio se trata de una naciente de carácter permanente y que se trata de la naciente NAC 1189, misma que ahora reportan a tan solo 48 metros de la casa, indicando en dichos informes coordenadas de ubicación geográfica del afluente muy diferentes, por lo que para el Tribunal lo indicado en el oficio DA-UHTPCOSJ-2262-2021 cobra relevancia en cuanto a si nos encontramos frente al mismo cuerpo de agua referenciado en uso de suelo, o en el informe de [Nombre8] o más bien se trata de otro cuerpo de agua, al respecto la Dirección de Aguas le informa al tribunal que “...Se informa que la nomenclatura CED3 y CED4 es propia del SENARA. Consultada su página no se encontró las coordenadas de las nacientes denominadas 257 y 258, por lo que no es posible corroborar lo solicitado.
En cuanto a la NAC 1189 según [Nombre8] se ubica en las coordenadas CED5 y CED6, misma que está cercana a la dictaminada con oficio DA-UHTPCOSR-0240-2019, sería necesario corroborar en campo si se trata de dos nacientes independientes o bien de la misma”. Y más adelante añadió: “El Ministerio Público y la Procuraduría han venido a hablar de la existencia de dos nacientes en el sitio, la 257 y 258, lo anterior, basados en el informe del SINAC practicado por [Nombre5] y [Nombre18] , en donde se señalaba que la construcción realizada por el imputado se ubicaba a 71. 5 metros del afluente que ellos identifican como naciente y que la ubicación geográfica según coordenadas de éste es CED7 horizontales y verticales 506347. Por su parte en el informe DIGH-1092-11 del Servicio Nacional de Aguas Subterráneas, Riego y Advenimiento se le informa a la fiscalía que para el 17 de noviembre del 2011 revisada la base de datos con que cuenta dicha institución en una radio de 2000 metros a la redonda donde se localiza la propiedad del encartado, se localiza una naciente que se identifica como la NAC 1189 misma que se ubica a 82 metros del sitio.
Pero una vez realizado el estudio de campo por esta entidad mediante el informe DIGH-UGH-OF-066-2012, los profesionales que asistieron a la inspección refieren la localización de una naciente ubicada ahora en las coordenadas CED8 [Dirección8] y [Dirección9] longitud este y cuya conclusión es que se trata de la NAC 1189 registrada de forma previa según la base de datos de dicha entidad y que la distancia entre la infraestructura y el afloramiento es de 48 metros. Es decir, ambas instituciones ni siquiera tienen claridad en cuanto a la nomenclatura con que identifican el cuerpo de agua, brindan distintas coordenadas y distancias entre la ubicación del afluente con respecto a la vivienda. Igual ocurre con el oficio de la Dirección de Aguas DA-UHTPCOSJ-2262-2021, que el Tribunal solicita, la cual no reconoce ninguna de estas nomenclaturas e indica que si bien bajo el oficio DA-UHTPCOSR-0240-2019, esa institución referencio una afluente como naciente ello en las coordenadas latitud CED9 y longitud CED10, para poder concluir certeramente que se trata del mismo afluente consultado o bien se trata de dos nacientes independientes sería necesario realizar la inspección en campo”.
Si bien es cierto que en la querella formulada por la Procuraduría se imputa que la construcción del imputado invade el área de protección de una de las nacientes que se encontraban dentro de la finca de su propiedad, sin indicar cuál (257 o 258), el problema que se plantea es que existen dudas sobre el afloramiento reportado por el SINAC, que dio origen a la denuncia de folios 1 a 14, sea el mismo cuerpo de agua que SENARE declaró posteriormente como naciente permanente. El argumento de la Procuraduría, básicamente, consiste en asegurar que como el funcionario del SINAC, Eliden Alcázar, visitó el afloramiento en tres oportunidades, acompañando tanto al perito de Ingeniería Forense como a los funcionarios del SENARE, tiene que tratarse del mismo lugar. Sin embargo, esta explicación es artificiosa. En el informe SOC-1434 del SINAC, se consigna que, para establecer la ubicación del afloramiento, se utilizó una cinta métrica y equipo de ubicación georeferencial GPS, obteniendo como resultado una distancia de 71,5 metros (cf. folio 1).
Sin embargo, en el informe DIGH-UGH-OF-066-1012, se afirma que se realizó una medición con un sistema GPS marca Garmin (de alta precisión) y el software ArcView 3.3., arrojando como resultado una distancia de 48 metros. Nótese, a simple vista, que se trata de dos ubicaciones notoriamente distintas, calculadas a través de equipos de alta tecnología, de modo tal que la presencia en ambas diligencias del señor Eliden Alcázar, no aclara la situación. La cuestión se complica aún más cuando el informe DA-UHTPCOSJ-2262-2021 revela que la numeración CED11, CED12 y CED4 es propia del [Nombre8] y que, consultada su página, no se encontraron las coordenadas de estas nacientes, por lo que no fue posible corroborar lo solicitado por el Tribunal, mientras que en lo referente a la CED13 , era necesario realizar un trabajo de campo para determinar si era la misma dictaminada en el oficio DA-UHTPCOSR-0240-2019 o se trataba de dos nacientes independientes.
De ahí que no es posible concluir con certeza, como conjeturan los apelantes, que el cuerpo de agua valorado por el SENARE (48 metros de la casa), sea el mismo que reportó SINAC ([Dirección10] de la casa) y que, a su vez, alguno de éstos corresponda realmente con las nacientes registradas CED14, o CED13 , como se describe en las piezas acusatorias. Pero, en todo caso, aun si pudiera establecerse que se trata del mismo afloramiento, al no poderse determinar que se trataba de una naciente permanente, igual lo procedente era la aplicación del artículo 9 del Código Procesal Penal. Por otra parte, en lo referente al tema de la ausencia de dolo por parte del imputado, nuevamente se observa que los apelantes mutilan la argumentación del Tribunal de Juicio. Sobre este tópico, se explica en sentencia que: “[…] la tesis de cargo en sus conclusiones indicaron que el conocimiento del hecho (elemento integrante del tipo penal) del encartado lo obtuvo en primera instancia desde el 03 de julio del 2008 con el oficio PUCC US 707-2008, documento emitido por la municipalidad de Grecia en el cual refería sobre la existencia de dos nacientes no captadas y que parte de la propiedad se encontrada dentro de la zona de protecci ón y por ende no se podía desarrollar ningún proyecto de construcción en el radio de 100 metros lineales.
Que este documento al estar dirigido al encartado era claro que este lo recibió y que desde ese momento [Nombre1] tenia el conocimiento de las nacientes y del radio de protección de las mismas, más sin embargo- aluden los dos entes acusadores- que a pesar de este conocimiento el encartado espera un año- como parte de su plan-, y en fecha 27 de agosto del 2009 presenta a la municipalidad la solicitud de permiso de construcción de una vivienda familiar de un piso y con un área de 120 metros de construcción, siendo que la Municipalidad de Grecia le otorga en un tiempo récord- según la fiscalía elemento indiciario a considerar también para acreditar el conocimiento del encartado de su ilicitud- de un día y se le concede el permiso para la construcción de dicha vivienda. Abona la representación de la procuraduría que era claro el conocimiento del encartado que el afloramiento de agua existente en el lindero norte de su propiedad correspondía a una naciente por cuanto este presenta hasta un año después para realizar los tramites en la municipalidad, teniendo la posibilidad de asesorarse en ese año para determinar en apego la ley el construir su vivienda.
Considera la fiscal ía y la Procuraduria que estos elementos indiciarios nos dan como única respuesta que el encartado tenia conocimiento de la existencia del cuerpo de agua y del radio de protección de éste y por ende de la imposibilidad de llevar a cabo una construcción en el sitio. Para el Tribunal dichos argumentos no tienen sustento probatorio-como se analizo supra- por cuanto de la misma prueba de cargo los indicios resultan ser anfibológicos; veamos: a) En primera instancia el oficio PUCC US 707-2008 como lo indico el testigo [Nombre13] este tipo de trámites en muchas de las ocasiones no se realizaban de forma personal, si bien van dirigidas al dueño o titular de bien, no necesariamente este es quien presenta la solicitud o bien quien la retira de la municipalidad, indica el testigo “...Cualquier persona puede presentar la solicitud de uso de suelo. A mi me han contratado para casos especiales porque es muy complicado pero se hacen siempre como si fuese el administrado quien hace la solicitud.
La solicitud realiza el señor porque fue firmada por el y esta con el número de cedula de el pero cualquier persona la pudo presentar …”(lo resaltado es propio). No tenemos elementos para desvirtuar en este caso que [Nombre1] como lo declaro en debate, hubiese contratado los servicios profesionales para realizar todos los trámites ante la municipalidad, como se extrae del Expediente digital de la Municipalidad de Grecia y del mismo Informe de Geotec, en que se acredita que [Nombre7] tuvo la asesoría del Arquitecto encargado de la obra quien hasta presenta una declaración jurada en el expediente de la Municipalidad, donde hace ver que el afluente no impedía la construcción de la vivienda contratada por cuanto no se encontraba en el radio de protección y un informe -que va dirigido al que en su momento era el encargado de los permisos de construcción [Nombre17] Corrales -del estudio de la Naciente por parte de la empresa Geotec en el cual se hace referencia que si bien existe un cuerpo de agua, éste es parte del flujo base de la Quebrada Flores y el radio de protección no es el que la municipalidad esta indicando en el uso de suelo, ni el que [Nombre19] y [Nombre8] reportan como naciente.
De la prueba más bien se acredita la versión de [Nombre1] en cuanto al desconocimiento de la existencia de una naciente que afectaba su propiedad y en el momento que adquiere ese conocimiento, busca la asesoría de la persona que en ese momento le estaban ayudando y es cuando presenta el estudio hidrogelógico que el personero de la Municipalidad encargado de los permisos le solicita y logra con ello terminar su construcción. b) La rapidez con que se otorgo el permiso de construcción y el tiempo en el cual el imputado solicita el mismo despu és de otorgado el uso de suelo, como bien lo indico en su declaración [Nombre7] pudo deberse a que tenía una persona dentro del municipio que le indico podía ayudar o bien como de la necesidad de contar con los recursos económicos para la construcción, el imputado debió de tramitar dos hipotecas con dos entidades diferentes para la construcción de la vivienda y que se acredito con el informe registral y con las declaraciones de [Nombre3] , o bien como la ya se demuestra en el expediente se debió a que no contaba con dinero para la construcción o que no existía prisa por construir y que estaba apenas diligenciando los trámites para iniciar su proyecto.
Además el mismo testigo [Nombre13] y [Nombre5] fueron contestes en indicar que la Municipalidad es la encargada de analizar estos documentos, que el mismo es requisito necesario para la tramitación de un permiso de construcción, con independencia del tiempo que este se expidió, y que el profesional a cargo del departamento de Planificación Urbana que en aquel momento lo era [Nombre17] tenia la obligación de constatar el cumplimiento de estos requisitos y otorgar o no el permiso de construcción. [Nombre13] refiere el “...Uso de suelo es requisito para permiso de construcción...se requería el plano catastro con visado, el uso, la carta de disponibilidad de agua y la eléctrica, el resto muy sencilla timbres estar al día en el pago de impuestos municipales, plano sellado por el Colegio de Arquitectos y el plano de construcción...Allí el funcionario otorga o no el [Nombre17] es un ex compañero arquitecto encargado de planificación Urbana, no recuerdo para que año entro 2006 y salio en el 2017 , no ejerció cargo de jefatura para conmigo, se creía jefe de todo el mundo, pero no era jefe mio.
La labor de él era otorgar permisos de construcción…” Ninguno de esos elementos considerados por la fiscal ía y la procuradur ía resultan ser graves, unívocos y contestes para acreditar [Nombre1] para el año 2009, tenia el conocimiento de que significaba “naciente”, de que la misma era de “carácter permanente” y que a raíz de esta caracterización que afectaba su propiedad si realizaba una construcción estaría infringiendo la ley Forestal”. Como puede verse, la argumentación del Tribunal de Juicio fue mucho más allá de los pocos renglones que se citan en ambos recursos y, además, contrario a lo afirmado en éstos, abarca los argumentos esgrimidos tanto por el Ministerio Público como por la Procuraduría en sus conclusiones. Ahora bien, para resolver los reclamos de los apelantes, lo primero a señalar es que si bien a folio 6 del expediente digital de la Municipalidad de Grecia se observa que el permiso de uso de suelo está dirigido al señor [Nombre1] , no consta ninguna razón de recibido.
Los apelantes suponen que una copia de dicho documento fue entregada directamente al interesado, deducción que hacen a partir del hecho de que éste fue dirigido al imputado y en el expediente constan otros oficios extendidos a petición de éste. Pero, igualmente, en estos otros documentos tampoco constan razones de recibido, por lo que cobra relevancia lo indicado por el testigo [Nombre13] , respecto a que estos trámites podía realizarlos cualquier persona, no necesariamente el interesado directo. Y esta afirmación resulta compatible con la versión del imputado, respecto a que dejó estos trámites en manos de otras personas. Dicho de otra manera, no hay prueba que ese documento realmente estuvo en poder del señor [Nombre1] . Por otra parte, si bien la declaración jurada firmada por el arquitecto de apellido [Nombre9] tiene fecha agosto de 2009, los apelantes parecen suponer -pues tampoco hay prueba al respecto- que la intervención de este profesión en el proceso de construcción de la vivienda del imputado, comenzó el mismo día que firmó dicha declaración, cuando las máximas de la experiencia señalan que por general las personas interesadas en construir o remodelar viviendas contratan a los arquitectos con antelación, éstos comienzan con los diseños y preparación de documentos, así como la gestión de permisos municipales, y cuando han completado las primeras etapas de recolección de documentos, presentan los contratos a las Municipalidades, de manera el hecho de que en este caso el contrato tuviese fecha agosto de 2009, per se, no descarta que el arquitecto de apellido [Nombre9] estuviere prestando asistencia al imputado desde tiempo atrás.
Como lo afirman los propios apelantes, una inversión tan alta como la que conlleva la construcción de una vivienda demanda, impone que el interesado procure ayuda en personas conocedoras de la materia y todo este proceso lleva tiempo. Pero incluso, aun asumiendo hipotéticamente que el señor [Nombre1] leyó el oficio PUCC US 707-2008, sucede que el testigo [Nombre1] , refiriéndose al contenido de éste, indicó: “El documento es un documento técnico de difícil interpretación para un administrado pero fácil interpretación de colegas míos que ejercen servicios profesionales independientes. En aquel momento no se presentaba ninguna declaración jurada de ese tipo que se estuviera respetando la zona de protección”. De lo depuesto por esta persona, se deriva que no necesariamente, por el simple hecho de que el administrado al que iba dirigido el documento leyera su contenido, automáticamente iba a adquirir una comprensión instantánea de su significado y alcances jurídicos, en este caso concreto, qué es una “naciente” y cuáles condiciones debe tener para considerarse “permanente”.
Pero más importante aún, de la lectura del oficio PUCC US 707-2008, se desprende que en ningún momento se le prohíbe al administrado la construcción de la vivienda; únicamente se le advierte que parte de la propiedad de encontraba dentro del área de protección de las nacientes no captadas 257 y 258 (sin indicar su ubicación específica), por lo que la edificación debía levantarse fuera del radio de cien metros. Es interesante que los apelantes citaran de manera tendenciosa algunas manifestaciones del testigo [Nombre13] respecto a que los permisos de suelo estaban dirigidos a los administrados, pero omiten referirse a la parte en que este mismo deponente reconoce que este tipo de resoluciones es de difícil comprensión para los ciudadanos comunes. Aquí es donde cobra especial relevancia la declaración jurada del ingeniero [Nombre9] , de folio 35 del expediente municipal, pues este profesional, quien era el responsable directo de la obra, asegura que la construcción se ubica fuera del área de protección.
Los apelantes hacen una lectura parcial de este documento, para extraer la conclusión de que el señor [Nombre1] tenía en su poder el oficio PUCC US 707-2008. Sin embargo, esta Cámara de Apelación considera más bien que este documento valida las conclusiones del Tribunal de Juicio, en el sentido de que el imputado había dejado la construcción en manos de este profesional, quien era el responsable de dirigir la construcción, por lo que resulta creíble la versión del señor [Nombre1] respecto a que éste se enteró de que la casa que estaba construyendo podría estar afectando un área de protección. Dicho de otra manera, habiéndose demostrado que existía un ingeniero a cargo de la obra, no hay prueba para afirmar que el justiciable tuviere razones para desconfiar de que lo indicado por el profesional [Nombre9] en la declaración jurada, o que del todo supiera que lo consignado ahí no era correcto.
Por esta misma razón, tampoco resulta atendible de la Procuraduría, respecto a que el imputado debía saber que, de acuerdo con el plano de la propiedad, no era posible realizar ningún desarrollo en la propiedad. Este alegato no es atendible, en primer lugar, porque parte de una presunción in malam partem de que el imputado poseía los conocimientos técnicos para leer e interpretar un plano, como también para hacer un cálculo acerca del área de construcción que podía desarrollar en su finca. En segundo lugar, de la literalidad del oficio PUCC US 707-2008 no se desprende en modo alguno que el administrado tuviese prohibición de construir. Simplemente se le indica que la obra debía estar fuera del área de protección. Si por razones de espacio no era viable construir una casa en dicho lugar, a quien le correspondía determinar eso era precisamente al ingeniero [Nombre9] , no al administrado. En ese tanto, nunca explican los apelantes en qué se apoyarían para sostener que el acusado le impuso a dicho profesional la construcción, pese a conocer la limitación, o que existió un acuerdo de ambos para desatenderla.
En tercer lugar, volviendo al tema de la contratación de un profesional, tampoco explican los recurrentes en cuál elemento de prueba se puede sustentar la afirmación de que el imputado tenía razones para desconfiar de las indicaciones de [Nombre9] , como responsable de la edificación, acerca de que no había ningún problema con la construcción, o bien que don [Nombre7] poseía los conocimientos técnicos para sospechar de la posible falsedad de lo consignado por el ingeniero en la declaración jurada, donde lo que se indica es que la construcción no afectaría el área de los afloramientos de agua. Por otra parte, se observa que los apelantes sesgan lo declarado por los testigos con respecto a la paralización y reapertura de la obra. Sobre este aspecto, el imputado declaró lo siguiente: “Como a los tres días o cuatro estaban trabajando ellos, cuando llega la municipalidad con unos sellos, me selló la obra y yo quede impactado de ver lo que estaba sucediendo, no pregunte nada al que puso los sellos, me vine para la municipalidad pregunte a don [Nombre17] no recuerdo los apellidos y al otro señor Esteban, pregunté muy preocupado por lo que estaba pasando Don [Nombre17] me dijo no queda más que presente un estudio no se si geológico, no recuerdo el término, me recomendó a un señor [Nombre6], le explico el asunto a él muy amable me dijo que él me ayudaba, le di los datos, la dirección donde era, el va ha la propiedad, duro como siete días u ocho y yo estaba muy preocupado un día me llama don [Nombre17] y me dijo que bajara yo me vine para la municipalidad estaba [Nombre17] en la oficina con Esteban yo estaba asustado de lo que iban a decir [Nombre17] me dijo: ud puede hacer la casa que le de la gana en ese lugar, él estaba muy contento de ver que era quebrada, me acuerdo que eso era lunes y el martes a las 8 subió don [Nombre17] y [Nombre14] a quitar los sellos y me dijeron que podía seguir la obra yo contento, este arquitecto [Nombre9] iba todos los días a ver la obra y nunca me dijo nada.
Cuando me para la construcción la casa iba a un 75 por ciento cuando el sube quita los sellos yo llamo a la gente y se sigue la construcción se siguió normal todo bien casa se termino todo tranquilo todo bien la casa estaba terminada me vine unos días a vivir allí yo estaba muy contento con la casa y al mes me llego notificación de lo que estaba sucediendo”. Ahora bien, acerca de la clausura de la obra, el testigo [Nombre14] declaró: “Ese tema si la obra culmino lo vio [Nombre17] hasta donde se él se encargo [Nombre17] ya que cuando se realizo el levantamiento de la obra le correspondió a otro inspector, toda vez que ha nosotros nos rotaban. Yo no fui el que fue en ese momento a quitar los sello con [Nombre17] normalmente él era quien iba […] [Nombre17] era el jefe de departamento de Ingeniería no se porque firmo en ese lugar de encargado de la obra, la firma que esta sobre la indicación testigo en ese momento recuerdo que era el maestro de obras que estaba en el lugar, fue e que firmo allí.
Toda la información que puse acta estaba acompañado de [Nombre17] , el fue hacer conmigo esa diligencia y el me indico lo que tenia poner ese día en el acta. El apartado de avance de la obra se ubica en el área de porcentaje que dice 80. No recuerdo si antes había ido a ese lugar. No se puede levantar una clausura si tienen sellos si esta en radio de una naciente en teoría pero el jefe mio era quien tomaba esas decisiones […] [Nombre17] que era el jefe tenia que dar el visto bueno de levantar la clausura de la obra […] Yo mencione eso porque en otra ocasión dijeron aquí mismo que se levantaron pero yo no me di cuenta que cuando fue, ni quien fue, no se si se levantaron o no, no me consta”. [Nombre5] declaró: “[…] nos dimos a la tarea de tomar más datos, fotos y medir el área de la casa e investigar en la municipalidad si contaba permisos nos entrevistamos ingeniero [Nombre17] y este nos indico que si había permiso se recabo información y se presento a la fiscalía de Grecia.
Al hablar con [Nombre17] le informamos que allí estaba la naciente y me dijo que si le presentaban un estudio geológico de la naciente el daba el permiso. No sabia si había un estudio geológico no teníamos acceso al expediente. La primer visita fue en noviembre del 2009, no recuerdo si fue en el mismo día o días posteriores hable con [Nombre17] no se se si se clausuro, entiendo que no […] No se si [Nombre17] sabia de la existencia de la naciente pero solo me dijo que si le presentan un estudio técnico otorgo el permiso”. En el mismo sentido, [Nombre6] refirió: “El estudio fue realizado para valorar unos supuestos manantiales que estaban descritos en esa zona por el Sinac y la necesidad de realizar le surgió a [Nombre7] porque cuando iba a construir una casa hubo una denuncia y la municipalidad se vio obligada a suspender el proceso constructivo y lo solicitaron estudio y el lo presento municipalidad de Grecia y en aquel momento la municipalidad no tienen área especializada para realizar esas valoraciones busco asesoría técnica de parte ambiental para que un consultor privado como yo y determinara si efectivamente esas son o no nacientes.
Y creo que [Nombre7] me busco a finales del 2009 y yo presente el estudio a inicios 2010 […] [Nombre17] conoció en la municipalidad es arquitecto actuaba como ingeniero municipal y creo que es la persona pidió el estudio […] Folio 100 a [Nombre17] se le dirige el informe porque [Nombre7] me lo pidió que lo dirigiera él. El estudio fue porque la Municipalidad se lo pidió”. Por su parte, [Nombre13] declaró: “Para ese momento no existían geólogos en la municipalidad. Sinae, [Nombre8] si tienen geólogos, los trabajos privados que hacen, yo no puedo evaluarlos. Puede que exista un retiro que afecte parcialmente la propiedad y fuera de esa área se puede construir o totalmente la propiedad y no se puede construir, de aprobarse si se puede pero no debería porque esta infringiendo la ley. La municipalidad aceptaba estudios geológicos privados, estudios sumamente caros se pedían análisis técnicos, lo que trababa de demostrar que estas nacientes estaban mal declaradas, cuando se contrataban estos estudios una vez municipalidad recibían no tenia capacidad de evaluar se elevaba al [Nombre19] tardaban un año o más para determinar si era o no naciente y se podía o no construir, esto se estuvo haciendo cuando yo estuve, se solicitaba al contribuyente, esto se hacia previo a la construcción cuando ud como su profesional tenia o no dudas si es o no naciente para que lo eleve la Dirección aguas, en algunas ocasiones los estudios servían, estaban mal declaradas en las mayorías no, estaban bien declaradas”.
Como puede verse, contrario a lo sostenido en los recursos, estos testigos refieren que, para la época de los hechos, era posible que los administrados presentasen a la Municipalidad estudios geológicos privados, para demostrar que una naciente estaba mal declarada como tal y, además, también respaldan la versión de que al señor [Nombre1] se le solicitó por parte de la Municipalidad que presentara un estudio geológico para descartar la presencia de nacientes permanentes cercanas al área de construcción, como condición para que pudiera terminarla. Además, dan cuenta de que se manejó la información de que [Nombre17] fue quien se encargó de atender esta situación, levantó los sellos y autorizó que se continuara con la obra. Pero más importante aún, independientemente de si en el expediente administrativo de la Municipalidad consta o no una resolución ordenando el levantamiento de los sellos (aspecto que nunca podría ser achacable al administrado sino a los funcionarios de la Municipalidad), lo que sí está claro es que fue realizado el estudio de GEOTEC, a solicitud del interesado, donde se concluye que los afloramientos de agua ubicados dentro de la finca del imputado no eran nacientes permanentes.
Lo anterior desvirtúa abiertamente la tesis sostenida por los apelantes de que el imputado actuó con dolo eventual, toda vez que fue informado por los inspectores de la Municipalidad de Grecia que la obra que estaba construyendo invadía el área de protección de una naciente, razón por la cual ésta fue clausurada, pese a lo cual siguió adelante. Por el contrario -y de esto sí existe certeza- al señor [Nombre1] le fue entregado un dictamen pericial elaborado por el geólogo [Nombre6] , en el cual se afirma, categóricamente, que los afloramientos de agua señalados por el SINAC, no eran nacientes permanentes, sino una quebrada, que era justamente la misma información que manejaba el imputado, lo que le permitió concluir la construcción. Con ese dictamen en su poder, no es posible afirmar que don [Nombre7] actuó con dolo eventual al proseguir con la obra, toda vez que tenía un criterio técnico -no refutado por ninguna autoridad en aquel entonces- de acuerdo con el cual la construcción que levantaba no estaba invadiendo ningún área de protección (a menos que los apelantes pudieran demostrar que el imputado poseía los conocimientos técnicos, o tenía razones fundadas para dudar de las conclusiones del informe de GEOTEC que avalaba la legalidad de la obra, cosa que no hacen).
Por último, de acuerdo con los hechos probados del fallo, no es cierto que el imputado “corrió” a vender su propiedad al enterarse de la causa penal, puesto que ésta dio inicio en el año 2009, el imputado fue indagado el 14 de junio de 2011 (cf. folio 17) y la negociación de la casa de habitación fue hasta el 2011, es decir, dos años después de la apertura de la causa. Nada de esto se puede “retrotraer” al año 2009, cuando se realizó la construcción de la casa, para alegar que en aquel entonces actuó con dolo. Por todo lo expuesto, se declaran sin lugar los motivos.
II.Como tercer motivo del recurso, se reclama inconformidad con la recepción, incorporación y rechazo de la prueba testimonial, con la consecuente aplicación errónea de los artículos 204 y 352 del Código Procesal Penal. Reclama que el Tribunal no permitió a la Procuraduría General de la República y a las partes el interrogatorio exhaustivo del testigo [Nombre17] , quien fue ofrecido por la defensa y mencionado por varios testigos como el funcionario municipal que aprueba el permiso municipal, quien da la orden de clausura, con quien se comunican los funcionarios del SINAC, a quien se le dirige el informe de GEOTEC, por lo que era un testigo importante para poder establecer el trámite del permiso municipal y de la emisión del uso de suelo, así como de la información que llevó a la clausura de la obra y la existencia en la Municipalidad de información del tema de las nacientes, incluso sobre el destino del informe de GEOTEC una vez recibido en la Municipalidad, incluso sobre la presencia del imputado en la Municipalidad previo a la emisión del permiso municipal.
No obstante, previo a la recepción de su declaración en juicio, el Tribunal consideró que dicho testigo tenía la condición de sospechoso, pese a que ni el Ministerio Público ni la Procuraduría lo tuvieron en ningún momento como investigado y, además, ya habían transcurrido más de 10 años desde los hechos. El único argumento del Tribunal fue que ese testigo había sido mencionado en el informe del SINAC por la emisión de los permisos municipales. Refiere el apelante que interpuso recurso de revocatoria, haciéndole ver al Tribunal que a dicho testigo nunca se le tuvo como autor de ningún delito y que, en todo caso, lo que se debía hacer era dejarlo declarar y sólo en caso de que de su declaración se pudiera advertir alguna auto incriminación, podía valorarse con esos elementos si era necesario advertirle sus derechos. Sin embargo, el Tribunal rechazó el recurso y le asignó un defensor público, quien le recomendó abstenerse de declarar, por lo que no fue posible interrogar al testigo.
Refiere que con ello se ocasionó agravio a la Procuraduría, puesto que no se le permitió interrogar a un testigo muy importante, pues no había que dejar de lado que el Tribunal absolvió por duda del conocimiento que tenía el imputado de un documento expedido por el departamento donde trabajaba el testigo [Nombre17] , quien fue la persona que emitió el permiso de construcción. Reitera que, conforme al artículo 204 del Código Procesal Penal, lo que correspondía era permitir que el testigo declarara y, solo en caso de que se advirtiera alguna responsabilidad, se le debían advertir sus derechos, llamando la atención que el Tribunal, para declararlo como sospechoso, hizo una valoración del informe del SINAC, pese a que en la presente causa nunca se le tuvo como posible autor de un delito, realizando una valoración de la prueba que no estaba permitida en esta etapa procesal. Solicita se anule el fallo impugnado y se ordene reenvío para nuevo juicio.
El motivo se declara sin lugar. Esta prueba testimonial, a criterio de esta Cámara, no tiene la trascendencia que el apelante pretende darle, porque tal como se expuso en el considerando anterior, aún asumiendo hipotéticamente que el señor [Nombre1] se presentó a la Municipalidad de Grecia a retirar el permiso de construcción, se trata de un documento que cuyo contenido no es fácilmente comprensible para un administrado -a diferencia de los profesionales de construcción- de manera que la simple lectura de éste no asegura, como suponen los apelantes, que éste comprendiera cabalmente qué es una naciente permanente, exactamente en qué parte de su finca se encontraban y dónde no podía construir. Además, el documento de uso de suelo no prohíbe la construcción, sino que únicamente gira instrucciones respecto a que ésta debía mantenerse fuera del área de protección, existiendo una declaración jurada por parte del ingeniero a cargo de la obra, donde éste informa que la casa de habitación se ubicaría fuera de dicha área, sin que los acusadores pudieran demostrar, con argumentos contundentes, por qué se le debía trasladar al señor [Nombre1] la responsabilidad del ingeniero [Nombre9] , encargado de la construcción la vivienda, o con base en cuáles elementos de prueba se podría derivar, con certeza, la conclusión de que el imputado tenía razones para dudar de la información que le dio el ingeniero que contrató, acerca de que no había problema para construir la vivienda en el sitio donde fue levantada, o tenía razones para dudar de las conclusiones del estudio de GEOTEC, respecto a que los afloramientos de agua que estaban a menos de cien metros de su casa, no eran nacientes permanentes.
Aunado a lo anterior, se explicó en el considerando anterior que tampoco logró demostrarse, con certeza, que los afloramientos de agua señalados por el SINAC y [Nombre8] constituyesen nacientes permanentes, elemento fundamental para la configuración del tipo delictiva, situación que no iba a cambiar con la declaración del señor [Nombre17] , de manera que tampoco se justifica la anulación del proceso por esta causa. En todo caso -y esto a mayor abundamiento- tampoco se observa que el órgano juzgador incurriera en una actuación arbitraria. El hecho de que una persona no haya sido objeto de investigación dentro del proceso no excluye la posibilidad de que se le pueda considerar testigo sospechoso, en el tanto pueda verse expuesta a brindar declaraciones en las cuales se auto incrimine como autor de un hecho punible. Respecto a este tópico, el apelante omite mencionar varias circunstancias particulares que se presentaron en este caso concreto.
En primer lugar, para el momento en que el testigo [Nombre17] fue llamado a estrados, ya se había incorporado como prueba en juicio la denuncia interpuesta por el SINAC, visible de folios 1 a 4, donde expresamente se dice: “En caso de que se determine que el señor [Nombre1] no tiene responsabilidad en los hechos denunciados, solicitamos que se investigue la actuación del Ingeniero de la Municipalidad de Grecia, en el sentido de si se dio un ilícito en el otorgamiento del permiso dentro del área de protección de una naciente permanente”. Nótese que en este documento ya se le está señalando como posible autor de un delito contra la probidad en la función pública. Por otra parte, si bien es cierto que esta persona fue mencionada por otros testigos, el apelante omite consignar qué fue lo que dijeron. Revisado el fallo, se tiene que, con respecto a la intervención de [Nombre17] en los hechos, [Nombre14] refirió: “Folio 187 se le muestra, esa es mi letra y el acta de clausura que se hizo, es la que me han mostrado en otras ocasiones, mi firma es la del centro, la que dice Inspector, borde izquierdo sobre la linea encargado de la obra [Nombre17] . [Nombre17] era el jefe de departamento de Ingeniería no sé porque firmo en ese lugar de encargado de la obra, la firma que esta sobre la indicación testigo en ese momento recuerdo que era el maestro de obras que estaba en el lugar, fue el que firmo allí […] No recuerdo haber visto un permiso de construcción visible si sé que la obra tenía permiso porque [Nombre17] me lo indico, pero de haberlo visto en el campo no recuerdo. [Nombre17] que era el jefe tenía que dar el visto bueno de levantar la clausura de la obra […] No sé si [Nombre17] podía hacer las gestiones de Inspector.
El fue conmigo porque el sabia que la obra tenia permiso, él fue al lugar conmigo porque tenia encargarse del asunto, para la clausura de una obra se requería del Inspector […] Normalmente dos [Nombre17] y el asistente revisaban si estaba afectado o no, no se porque en este caso no se dieron cuenta o no estaba afectada porque ellos revisaban antes de conceder el permiso. Antes de esto no recuerdo haber realizado este tipo de diligencia”. Por su parte, [Nombre13] refirió que: “Supe que se otorgó el permiso de construcción porque en la sala de testigos estaba un amigo mío que era testigo y que todo esto se dio por cuanto se otorgo un permiso de construcción. Me contó el testigo que si pero no me consta si se clausuro o no. En aquel entonces se requería el plano catastro con visado, el uso, la carta de disponibilidad de agua y la eléctrica, el resto muy sencilla timbres estar al día en el pago de impuestos municipales, plano sellado por el Colegio de Arquitectos y el plano de construcción.
Allí el funcionario otorga o no el permiso […] El permiso de construcción puede anularse y se podría volver a dar. Debe de existir acto administrativo y el consejo municipal debe de ver ese caso. El permiso lo emite un profesional del departamento de Planificación. Se que en aquel momento se había anulado unos permisos que tenían ciertos problemas administrativos, no se si den mismo caso pero cuando existe una clausura es para que el administrado resuelva lo solicitado por la municipalidad. En la clausura se debe de indicar al administrado se debe decir el porque de la misma y se le da cierto tiempo en la ley esta establecido […] El administrado debía de solicitar a la municipalidad el visado y el uso de suelo ambos tardaban 15 días en entregarse, los requisitos del permisos regularmente lo hacia el administrado o el profesional, debe de recolectar todo el resto de requisitos de una lista que entregaba la municipalidad 8 a 10 requisitos y plano estaban sellados y tasados por el Colegio se presentaba ese legajo a la plataforma municipal para que esta trasladara a planificación urbana y control constructivo el cual tardaba 10 días para otorgar o no el permiso o licencia construcción.
El profesional debía de revisar todo lo presentado por al administrado. Si había duda se solicitaba ayuda al departamento jurídico o catastro y en caso que persistiera la duda se buscaba profesional mas capacitado. Si había duda se debía de asistir la [Nombre19] para verificar la existencia y el número de naciente. Existen protocolos que se establecían la función de cada uno de los profesionales pero el control interno no estaba tan especializado como ahora, no se si el profesional lo hizo o no”. Nótese cómo, aunado a la denuncia del SINAC, en este caso particular, de lo depuesto por los testigos, se desprenden posibles actuaciones irregulares por parte del señor [Nombre17] en el ejercicio de sus funciones, no solamente en cuanto al otorgamiento presuntamente apresurado de los permisos de construcción, sino también en cuanto a la concesión de la autorización para la reanudación de la obra sin cumplir con los procedimientos administrativos, lo que ya permitía al Tribunal, desde ese momento, vislumbrar que la eventual declaración que esta persona podría depararle responsabilidad por su intervención en estos hechos.
En un caso muy similar al que aquí nos ocupa, el Tribunal de Apelación de Sentencia, mediante el voto No. 2020-1121 de las 10:25 horas del 8 de julio de 2020 -citado de manera incompleta por el recurrente- se pronunció en los siguientes términos: “En los argumentos que se plantean, se discute que no fue posible extraer información de calidad con la reproducción de lo declarado por el testigo, ni mucho menos se permitió al querellante y actor civil ejercer un interrogatorio eficaz para establecer las responsabilidades del imputado y demandado civil. Lo anterior porque, pese a que el juzgador no utilizó el procedimiento común ante la recepción de la declaración de un "testigo sospechoso" (advertencias constitucionales sobre su derecho de abstención y a contar con un acompañamiento letrado, ya que debe dispensársele el mismo trato que a cualquier imputado), sí limitó a las partes en el sentido de que no podían formular un interrogatorio cuyas respuestas pudieren derivar en una "autoincriminación." De previo, conviene precisar que testigo “es aquel que, sin ser imputado, expresa el conocimiento que tiene con respecto a los hechos sobre los que gira el proceso, conocimiento adquirido por cualquiera de sus sentidos”.
(Llobet Rodríguez, Javier, Proceso Penal Comentado, 6ª edición, San José, Editorial Continental, 2017, pág. 349), mientras que, por su parte, el artículo 81 del Código Procesal Penal establece que imputado es “a quien, mediante cualquier acto de investigación o del procedimiento, sea señalado como posible autor del hecho punible o partícipe en él”, de modo que así se establecen los límites a la actividad punitiva estatal y privada a fin de proteger los derechos y garantías que corresponden a cada uno de esos sujetos en el proceso, entre los cuales figura el de asistencia técnica y el derecho de abstención (artículo 36 de la Constitución Política) e, incluso, el de abstención para los testigos, en el caso de los supuestos contemplados en el numeral 205 del Código Procesal Penal. Este preámbulo permite afirmar que, si bien es cierto, conforme el artículo 204 del Código Procesal Penal, el testigo tiene un deber legal de atender al llamado judicial y, bajo fe de juramento, declarar, esto incluye excepciones, entre ellas: que ejerza la facultad de abstención, en virtud de una relación de consanguinidad o afinidad con el propio imputado, según las reglas del numeral 205 del Código Procesal Penal; que los hechos sobre los cuales se requiere su declaración pudieren incriminarlo penalmente (supuesto al que le ha sido asignada, en la práctica, la denominación de "testigo sospechoso”) o que figure como imputado absuelto o sobreseído por los eventos a los que deba referirse.
Es decir, cuando de los antecedentes del proceso surge la posibilidad de imputarle alguna responsabilidad en los hechos investigados, o acusados, según sea el caso, e incluso de auto incriminación (sin que ninguna parte lo haya planteado de esa forma) asiste a la persona ("testigo sospechoso") el derecho de abstención y de contar con patrocinio letrado. Aunque el establecimiento y determinación de esta figura ha presentado serias dificultades, pues incluso puede generar arbitrariedad, lo cierto es que se deriva del numeral 91 del Código Procesal Penal que refiere “Cuando exista motivo suficiente para sospechar que una persona ha participado en la comisión de un hecho punible, el funcionario del Ministerio Público encargado de la investigación procederá a recibirle declaración, con arreglo a las disposiciones de este código ” (la negrilla no corresponde al original), pero tal condición (de "testigo sospechoso") podrá excluirse, válidamente, cuando la "sospecha" que le atribuye esa condición desaparece o se diluye a lo largo del proceso con ocasión de la incorporación de probanzas legítimas que descarten su intervención en el hecho punible o bien si aplicado un criterio de oportunidad, conforme a la regulación de los artículos 22 y 23 del Código Procesal Penal, y superado el plazo de quince días después de la firmeza del fallo respectivo, se alcanzó la expectativa del ente acusador.
Sobre este supuesto ha de indicarse que si, en el caso particular, el Ministerio Público o la Procuraduría General de la República, como depositarios de la acción penal, decidieron no acusar a [Nombre21] y se reservaron la posibilidad de mantenerlo como testigo en virtud de ínfima participación, por ejemplo, tuvieron la posibilidad real y legal de aplicar este instituto y con ello evitar estas discusiones. Sin embargo, al no haber procedido de esa forma, lo legalmente esperable era que el tribunal, de previo a recibir la declaración de [Nombre21] , le informara sobre su derecho constitucional de abstención y le otorgara la posibilidad de contar con un defensor público o uno de su confianza, lo que, en todo caso, no eximía al juez de mantenerse atento y advertir cualquier circunstancia que pudiera deparar responsabilidad al declarante y así tomar acciones para garantizar sus derechos.”. Naturalmente, la necesidad de que el Tribunal de Juicio, previo a la recepción de un testigo, le advierta de su condición de ”sospechoso” y le informe de su derecho de abstenerse de declarar, deberá valorarse de acuerdo a las características y particularidades de cada caso concreto, pues en muchas ocasiones no existen elementos objetivamente constatables que, ex ante y razonablemente, permitan al Tribunal valorar que esta persona podría comprometerse a sí misma al rendir declaración, por lo que se será hasta el momento en que ésta exponga su testimonio, que tales elementos podrían surgir a la luz, por lo cual los juzgadores deben estar muy atentos al relato de la persona, prestos a informarle de sus derechos y prevenirle sobre la posibilidad de ser asistido por un defensor.
Sin embargo, en este caso particular, de acuerdo con la prueba recibida en debate, tales indicadores sí existieron y fueron oportunamente percibidos por el Tribunal, de manera que el cuerpo juzgador actuó apegado a Derecho al informarle al señor [Nombre17] que podía ser asistido por un abogado defensor. Por lo expuesto, se declara sin lugar el motivo.
III.Como cuarto motivo del recurso, se reclama inconformidad con la reapertura del debate, decretada por el Tribunal al incurrir en una falta de fundamentación intelectiva y probatoria, con violación al principio de libertad probatoria. Reprocha que, luego de finalizada la etapa de conclusiones, el Tribunal de Juicio dispuso la reapertura del debate con fundamento en el artículo 362 del Código Procesal Penal, pero nunca fundamentó la necesidad de solicitar dicha prueba nueva, sobre todo porque ya se había aportado al proceso prueba técnica al amparo del principio de libertad probatoria. Luego de transcribir las respuestas que la Dirección de Aguas remitió al Tribunal de Juicio, reprocha que dicha institución contestó al órgano juzgador que no era posible atender algunas de sus inquietudes, ya que ello llevaría más tiempo y además era necesario realizar una inspección en verano de 2022, aspecto técnico que ya era conocido por el Tribunal puesto que desde el inicio los geólogos que declararon en debate señalaron que un estudio de esta naturaleza debía realizarse en época seca.
No obstante, el Tribunal, de manera infundada, toma la decisión de requerir un criterio técnico en plena época de invierno, y luego de que la Dirección de Aguas emite el informe los juzgadores toman algunos aspectos de éste para calificar el estudio de la Dirección de Aguas como “empírico”, cuestionar la información técnica y acrecentar la duda. Solicita que se anule el fallo impugnado y se ordene reenvío para nueva sustanciación. El motivo se declara sin lugar. El artículo 362 del Código Procesal Penal dispone que: “Si el tribunal estima, durante la deliberación, absolutamente necesario recibir nuevas pruebas o ampliar las incorporadas, podrá disponer a ese fin la reapertura del debate. La discusión quedará limitada, entonces, al examen de los nuevos elementos de apreciación aportados”. Nótese que, de la redacción de la norma, no se desprende que, para disponer la reapertura del debate, el Tribunal deba fundamentar de manera profusa su decisión.
Lo único que se exige, es que durante la deliberación los juzgadores consideren absolutamente indispensable recibir esa prueba, bastando con que informen de su decisión a las partes que, en todo caso, deberán tener acceso al examen de esta prueba nueva. El artículo no prevé la posibilidad de que las partes puedan oponerse a esa reapertura y/o cuestionar las motivaciones del Tribunal. De ahí entonces que el alegato del apelante, respecto a que dicha prueba era innecesaria porque ya existía prueba técnica suficiente para acreditar los hechos acusados, constituye una consideración particular sobre el caso que, por sí sola, no determina que la actuación del Tribunal de Juicio, en este caso concreto, fuese arbitraria. Tal como se explicó en el considerando segundo de la presente resolución, el órgano juzgador contaba con criterios contrapuestos entre los peritajes de SENARE y Geotec sobre la caracterización de los cuerpos de agua ubicados en la finca del imputado, por lo que a criterio de esta Cámara resultaba razonable consultar a la Dirección de Aguas, que es precisamente la entidad competente para determinar si un afloramiento puede ser calificado como una naciente permanente.
Comentando los alcances de este artículo 362, señala la doctrina nacional que: “Se trata de una norma problemática desde la perspectiva de la imparcialidad del juzgador […] Se parte de que la reapertura de la prueba se puede disponer tanto para pedir prueba que pueda perjudicar al imputado, como para solicitar prueba que lo pueda favorecer […] Sin embargo, en la práctica la reapertura del debate se dispone en casos en que se pretende allegar prueba incriminatoria en contra del imputado. Lo correcto es que si en la deliberación hay duda, lo que corresponde es el dictado de la sentencia absolutoria y no disponer la reapertura del debate para ordenar una prueba adicional […] Lo lógico es que al disponerse la reapertura no puede ordenarse prueba de cargo, sino solamente de descargo, como lo propone [Nombre22] , pero esto no deja de ser problemático, ya que en contra de lo previsto, el resultado puede llegar a perjudicar al imputado […] Debe insistirse en que si hay duda, lo que corresponde es absolver.
Sin embargo, la reapertura del debate en la práctica no ha seguido ese criterio y con frecuencia se ordena buscando completar la prueba incriminatoria del Ministerio Público, en contra del principio acusatorio y de imparcialidad […] La justificación que se le trata de dar a la prueba ordenada al abrirse el debate, es que se trata de una medida para mejor proveer basada en el principio de “verdad material”. Debe ser ejercida solo en casos excepcionales, ya que altera el orden normal del proceso. Por ello se requiere que sea “absolutamente necesario” recibir nuevas pruebas” ([Nombre23] , Javier. Proceso Penal Comentado. San José, Editorial Jurídica Continental, 6° edición, 2017, pp.- 546-547). Partiendo de lo anterior, si en el caso concreto el Tribunal de Juicio tenía dudas sobre la caracterización del cuerpo de agua objeto de estudio, lo que debió hacer fue absolver directamente al imputado en aplicación del principio in dubio pro reo, en vez de reabrir el debate para solicitar este informe a la Dirección de Aguas, cuyo resultado bien pudo haber terminado favoreciendo a la tesis acusatoria.
En consecuencia, resulta inaceptable la afirmación de que esta actuación del Tribunal de Juicio causó “agravio” al Ministerio Público y a la Procuraduría, pues perfectamente pudo haber ocurrido que esta prueba nueva viniera más bien a afianzar la postura de éstos, respecto a que el afloramiento de agua efectivamente era una naciente permanente, porque estaba alimentada de aguas subterráneas, permitiéndole al Tribunal decantarse por el peritaje elaborado por SENARE, de manera que quien pudo haber resultado perjudicado fue el propio señor [Nombre1] . Por otra parte, no resulta de recibo el reclamo de que dicha prueba era impertinente, puesto que el geólogo [Nombre4] había advertido que este tipo de investigaciones de campo, como las que el Tribunal solicitó a la Dirección de Aguas, debía hacerse en época seca. Tal como se indicó en el considerando segundo de la presente resolución, la responsabilidad por esta situación no es trasladable al cuerpo juzgador, puesto que, si desde el principio se conocía que por disposición legal le correspondía a la Dirección de Aguas la caracterización de un afloramiento, no se entiende por qué entonces, durante la etapa preparatoria, ni el Ministerio Público ni la Procuraduría General de la República, nunca solicitaron el criterio técnico de dicha dependencia.
De ahí que no es responsabilidad del Tribunal que, cuando sus integrantes determinaron la necesidad de contar con este estudio, para la Dirección de Aguas no fuese posible la realización de éste, debido a la época del año en que se realizó el debate, debiendo reiterarse aquí que este problema no se hubiese presentado si, con anterioridad, la parte acusadora se hubiera ocupado de hacer llegar esta prueba a los autos. Por lo expuesto, se declara sin lugar el motivo.
IV.Como quinto motivo del recurso, se reclama falta de fundamentación del rechazo de la solicitud del derribo de la obra. En síntesis, sostiene que la motivación del fallo con respecto a este extremo, es insuficiente, al no analizar la prueba que determina la existencia de una naciente y de una zona de protección, pero sobre todo no realizar ninguna fundamentación jurídica y no tomar en cuenta los principios precautorio y pro natura, que deben ser observados cuando se trata de actuaciones contra el medio ambiente. El motivo se declara sin lugar. El problema con la argumentación del apelante es que en todos los casos que dieron lugar a los precedentes de jurisprudenciales que cita (tanto de la Sala Constitucional como de los Tribunales de Apelación), independientemente de la absolutoria del imputado, sí se logró demostrar que existió invasión a un área de protección, así como una afectación real al medio ambiente.
Sin embargo, es justamente lo que no se logró acreditar en el caso de estudio. En efecto, los hechos que se tuvieron por demostrados en sentencia fueron los siguientes: “PRIMERO: Para el año 2008, el encausado [Nombre1] construyo una vivienda en la propiedad ubicada en San Isidro de Grecia, [Dirección11] , , finca inscrita en el partido de Alajuela, matrícula de folio real número CED15, ubicación geográfica en las coordenadas horizontales [Dirección12] y verticales [Dirección13], hoja cartográfica Naranjo, escala 1:50.000, que mide 3.300 metros cuadrados y por la cual discurre un cuerpo de agua. SEGUNDO: Para el mes de abril 2011, el encartado [Nombre1] , sabiendas del proceso penal número 09-204266-0331-Pe seguido en su contra por el delito de Infracción ley Forestal, donde el objeto, sobre el cual recae dicha infracción forestal, lo era la propiedad partido de Alajuela, matrícula de folio real número CED15, le vende a los ofendidos [Nombre2] y [Nombre3] en la suma de CIENTO TREINTA MILLONES DE COLONES, ocultándoles el proceso penal 09-204266-0331-PE, en el cual se discutía limitaciones a la propiedad que le hacían imposible el disfrute de esta, produciendo un perjuicio económico a los éstos en su patrimonio.
TERCERO: Que el encartado [Nombre1] no cuenta con juzgamientos anteriores”. Nótese que una de las razones por las que el imputado fue absuelto, es justamente que la prueba técnica de cargo resultó insuficiente para demostrar que ese cuerpo de agua fuese una naciente permanente. Y si esto es así, tampoco se puede afirmar la existencia de un daño al medio ambiente, por lo que en estas circunstancias resultaría arbitrario ordenar el derribo de la obra. Por lo expuesto, se declara sin lugar el motivo.
POR TANTO:
Se declaran sin lugar los recursos de apelación de sentencia interpuestos por el Ministerio Público y la Procuraduría General de la República.
