N° 0424-2022-II TRIBUNAL DE APELACIONES DE CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. Segundo Circuito Judicial de San José, Dirección19654 . , at seven thirty in the morning on veinticinco de noviembre de dos mil veintidós.

Objection for failure to join necessary defendants (excepción de falta de integración del litis consorcio pasivo necesario), within the ordinary proceedings instituted by ASOCIACIÓN DE DESARROLLO INTEGRAL DE LA RESERVA INDÍGENA DE QUITIRRISÍ against COMISIÓN NACIONAL DE ASUNTOS INDÍGENAS, INSTITUTO DE DESARROLLO RURAL (hereinafter INDER), AND Nombre164051 . ., with a counterclaim (reconvención) by Nombre164051 . . against INSTITUTO DE DESARROLLO RURAL. The appeal against Order number 1310-2022, issued at 15:25 on nueve de agosto de dos mil veintidós by the Tribunal de lo Contencioso Administrativo y Civil de Hacienda, is before the Court.

WHEREAS:

I. REGARDING THE PROVEN FACTS

For purposes of issuing this decision, the following is deemed established: “A) Counsel for Instituto de Desarrollo Rural raised the defense of improper joinder of the parties (indebida integración de la litis), requesting that Asociación de Desarrollo Integral de Quitirrisí de Mora, the State, and Sistema Nacional de Áreas de Conservación be joined in the proceedings (See electronic case file). B) By Decision 1310-2022, issued at fifteen hours and twenty-five minutes on nueve de agosto de dos mil veintidós, Tribunal Contencioso Administrativo ruled: ‘The preliminary defense (defensa previa) of failure to join necessary defendants raised by counsel for INDER is denied’ (See electronic case file). C) Counsel for INDER appealed this determination (See electronic case file). D) By decision issued at eleven hours and fifty-five minutes on diecinueve de agosto de dos mil veintidós (See digital case file).

II. REGARDING THE GROUNDS FOR APPEAL

In support of the appeal, the appellant states:

“Although, according to one line of case law, because this is a Civil Treasury proceeding, the plaintiff has the power to sue whomever it chooses, the fact remains that the substantive and procedural law governing Indigenous territories already expressly assigns responsibilities and duties to each State institution and to the State itself. // For its part, the institution of joinder (litis consorcio) seeks to ensure the proper formation of the adversarial proceeding because, since the substantive legal relationship is indivisible, it is essential, insofar as the defendant side is concerned, that all parties responsible for opposing the asserted claim participate in the proceedings. // Accordingly, pursuant to Article 12, subsections 3 and 4, CPCA + 106 C. Procesal Civil, which establishes the need to join the parties when .... Given that there is a substantive legal relationship between the claims in the complaint and the functional role of the parties sought to be joined, it is important that joinder be properly effected, since otherwise the merits of the matter cannot be adjudicated. // A) REGARDING THE STATE: Over time, in judicial proceedings of this nature involving Indigenous territories and requests to initiate expropriation proceedings (proceso expropiatorio), the parties have consistently advanced opposing positions: private parties maintain that INDER and CONAI share responsibility (and, in some cases, even the State, if it has been joined) for the failure to initiate those expropriation proceedings, which include all stages—mediation, appraisal, and payment—whereas both INDER and CONAI maintain and have repeatedly argued (at every procedural stage of numerous court cases) that, with respect to Indigenous matters, the law already expressly assigns responsibilities and duties to each State institution and to the State as such. // Accordingly, although there may be responsibility regarding expropriation procedures (which include mediation, censuses, appraisals, among others), INDER fulfills this administrative responsibility when, at the institutional level, a national flagship initiative is created and, beginning in marzo de 2016, the so-called Plan de Recuperación de Territorios Indígenas (hereinafter Plan-RTI) is implemented, with the principal objective of carrying out those expropriation procedures to recover such lands, namely:

  • 1)collection of information,
  • 2)boundary marking (amojonamiento),
  • 3)consensuses,
  • 4)topographic surveying. The fact remains that these expropriation procedures do not include, and there is no obligation concerning, payment from its own budget, because it is the State upon which the law imposes the following responsibilities: a) the obligation to register the Indigenous reserves in the Public Registry (in accordance with Article 2 of the Ley Indígena); b) the obligation to finance and pay compensation (in accordance with Article 5 of the Ley Indígena and the Ley de Expropiaciones). For its part, Article 5 of the Ley Indígena provides: .... As follows from the regulations cited above, Article 5 of Ley Indígena No. 6172 establishes that studies and procedures for expropriation and compensation within Indigenous territory shall be carried out by Instituto de Desarrollo Agrario, now Instituto de Desarrollo Rural, in coordination with CONAI. The fact remains, however, that Article 5 is also clear in providing, in its third paragraph, that such expropriations and compensation shall be financed by the State; therefore, payment for the expropriations must be made by the State. In other words, INDER is responsible only for relocation, expropriation, and coordination—not payment, as is being sought. // It is the Costa Rican State that has the legal obligation to provide the financial resources as the creator of the Indigenous territories. I reject the respected court’s statement that, if judgment is entered against INDER, it must bear the financial costs of an adverse judgment; this is reckless, and the institution’s financial inability to respond to these claims involving Indigenous territories is well known. ..... As CGR stated, INDER faces imminent financial peril due to the possibility that it may have to make monetary disbursements to pay for lands incorporated into Indigenous territories; it is essential that the State be named as a defendant in these proceedings and in all such cases heard before the Contentious-Administrative Court..... Accordingly, given that there is a substantive legal relationship between the claims in the complaint and the functional role of the State, which is responsible for paying or financing that compensation, it is important that joinder be properly effected, since otherwise the merits of the matter cannot be adjudicated. ...b) REGARDING ASOCIACIÓN DE DESARROLLO INTEGRAL DE LA RESERVA INDÍGENA DE QUITIRRISÍ DE mORA (ADI) // With respect to ADI, it is essential that the Indigenous community be joined, as it is clearly affected by the counterclaimant’s claims and by any eventual determination of a right in the counterclaimant’s favor, since this could increase the area of the lands over which the community is to exercise effective possession and which it would be responsible for receiving and administering. In addition, a particular circumstance arises concerning its joinder in the proceedings: because ADI is the plaintiff (in the principal complaint) and Nombre164051 . A. has been joined in the counterclaim as a co-defendant ... in order to achieve identity of the parties, Nombre164051 must direct its claims against ADI, as provided in Article 106 CPC.... d) REGARDING SINAC: Given that technical report AT-647-2015 concludes that the Rodeo Protected Zone is affected, it is important to join SINAC in the proceedings so that it may confirm that its interests are not affected. It must be borne in mind that neither INDER nor any of the private parties in these proceedings has the authority to determine whether the National Heritage of the State (Patrimonio Nacional del Estado) is affected, and, due to the very nature of the lands, this analysis by the competent entity is important.” (See digital case file).

III. REGARDING THE ASSOCIATION’S POSITION

Counsel for the association states the following regarding this issue:

“Regarding the JOINDER OF THE STATE in these proceedings, it must be rejected for the following reasons: // FIRST: To determine the PARTIES TO PROCEEDINGS, reference must be made to ARTICLE 220 CPCA and, on a supplementary basis, to ARTICLE 22 OF THE CÓDIGO PROCESAL CIVIL, which establishes two conditions: // SECOND: The SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA has also ruled on the issue of the State’s participation IN LAND COMPENSATION PROCEEDINGS WITHIN INDIGENOUS RESERVES, by means of VOTO NÚMERO 001604-F-S1-2012 DE LAS NUEVE HORAS DEL SEIS DE DICIEMBRE DE DOS MIL DOCE:// In CONSIDERANDO NÚMERO VI, regarding the MANDATORY JOINDER (litisconsorcio) OF THE STATE, it states that INDER is an AUTONOMOUS PUBLIC-LAW INSTITUTION WITH LEGAL PERSONALITY, ITS OWN ASSETS, AND ADMINISTRATIVE INDEPENDENCE; consequently, there is no need to involve the State, because this obligation pertains solely to INDER, in coordination with CONAI.

In CONSIDERANDO VIII, the Chamber is unequivocal IN ITS DIRECT CHALLENGE, stating: // ‘It is clear to the Chamber that INDER has, insofar as relevant to this case, the following duties: 1) to relocate good-faith owners or possessors outside the indigenous reserves; and 2) to expropriate their properties and compensate them if relocation is not possible. The particular arrangement devised for financing and administering the fund does not alter the fact that, under the provision, it is clearly the defendant Institute, in coordination with CONAI, that is responsible for carrying out the expropriation procedures (trámites expropiatorios).’ (Emphasis added) // Sala Primera reaffirmed this again in VOTO NÚMERO 1443 DE LAS 13 HORAS 50 MINUTOS DEL 23 DE NOVIEMBRE DEL 2017, in CONSIDERANDO V Y VI, where it sets forth the same argument and concludes: // ‘Since there are no grounds for departing from this position, because Ley no. 6172 is special legislation that confers the duty to provide compensation upon Inder and Conai, and for the reasons already stated, the challenge under consideration concerning joinder of the State must be denied.’ (Emphasis added) // THIRD: As can be seen FROM THE CLAIMS IN THE COMPLAINT included in these ordinary proceedings (Proceso de Conocimiento), NONE IS DIRECTED AGAINST THE STATE, and none requests its intervention or the performance of any act.

INDER AND CONAI are the entities that have maintained CONTINUOUS OMISSIVE CONDUCT (conducta omisiva continua) since 1977, not the STATE. What is being requested in these proceedings IS REMEDY OF OMISSIVE CONDUCT BY CONAI AND INDER PURSUANT TO ARTICLE 5 OF THE LEY INDÍGENA AND ARTICLE 35 CPCA. // FOURTH: As the case file shows, these are CIVIL PROCEEDINGS INVOLVING THE PUBLIC TREASURY (Proceso Civil de Hacienda), brought solely to RESOLVE STRICTLY PROPRIETARY OR PECUNIARY MATTERS involving the Administration’s FAILURE TO ACT, and therefore the claimant has the authority to decide whom to sue and has no interest in the State participating, for the reasons stated above. // Regarding the JOINDER OF SINAC in these proceedings: // Based on the legal grounds and judicial precedents stated above, NEITHER THE STATE, NOR SINAC, NOR ANY OTHER INSTITUTION SHOULD be joined in these proceedings, because the relief sought is remedy of OMISSIVE CONDUCT PURSUANT TO ARTICLE 5 LEY DE ASOCIACIONES; unfortunately, however, Sala Primera de la Corte Suprema de Justicia held otherwise in VOTO 001250-F-S1-2021 de las once horas cuarenta y cinco minutos del diecisiete de agosto del dos mil veintiuno. // In that decision, the Chamber vacated a judgment in favor of a registered owner whose ownership predated Ley Indígena, finding IMPROPER JOINDER OF THE PARTIES (indebida composición de la litis) and stating that SINAC must be joined because properties located in PROTECTIVE ZONES (zonas protectoras), such as Zona Protectora Cerros de Escazú, where the property at issue in these proceedings is located, form part of the STATE’S NATURAL HERITAGE (Patrimonio Natural del Estado) as public-domain property whose conservation and administration are entrusted by law to Ministerio del Ambiente y Energía through Sistema Nacional de Áreas de Conservación SINAC. // ‘It should be noted that Área de Topografía del Inder (folios 59 and 60 of the court file) determined, through Oficio AT- 356-2014 del 05 de agosto 2014, that plano SJ-1289536-2008—the land disputed by the claimant—is affected by Área Silvestre Protegida Zona Protectora Cerros de Escazú.

In other words, that Zona Protectora forms part of Patrimonio Natural del Estado as public-domain property whose conservation and administration are entrusted by law to Ministerio del Ambiente y Energía through Sistema Nacional de Áreas de Conservación, SINAC, ….’ (Emphasis and underlining added.) // By vacating the judgment on the foregoing grounds, Sala Primera committed a very serious and deeply troubling error, particularly because it is the highest court of the Poder Judicial in this field, by treating Patrimonio Natural del Estado and Zona Protectora as equivalent, which is incorrect, as explained below: // Under ARTICLE 13 LEY FORESTAL, PATRIMONIO NATURAL DEL ESTADO consists of forests and forestlands (terrenos forestales) within national reserves belonging to the State, Municipalidades, Instituciones Autónomas, and other agencies of the Administración Pública; THEY ARE AREAS DECLARED INALIENABLE AND WITHIN THE PUBLIC DOMAIN THAT BELONG TO THE STATE. // Article 13 of LEY FORESTAL 7575 so provides: ‘Patrimonio Natural del Estado shall consist of the forests and forestlands within national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalidades, instituciones autónomas, and other agencies of the Administración Pública (emphasis and underlining added).’ // By contrast, a PROTECTIVE ZONE (zona protectora) consists of forests and lands suitable for forestry (terrenos de aptitud forestal) that are PRIVATELY OWNED BECAUSE THEY HAVE PRIVATE OWNERS IDENTIFIED IN THE REGISTRO PÚBLICO and are subject to a forestry regime (régimen forestal) governing the conservation, renewal, and use of forest resources, as stated in ARTICLE 37 OF LEY DEL AMBIENTE: // ‘Private properties affected pursuant to this article because they are located in national parks, biological reserves, wildlife refuges, forest reserves, and protective zones shall become part of state-protected areas only once they have been paid for or legally expropriated, except when they are voluntarily made subject to the Régimen Forestal.

In the case of forest reserves, protective zones, and wildlife refuges, where payment or expropriation has not occurred, the areas shall, pending such payment or expropriation, be subject to an environmental land-use plan (plan de ordenamiento ambiental) that includes an environmental impact assessment (evaluación de impacto ambiental) and, subsequently, a management, recovery, and resource-restoration plan. (Emphasis and underlining added.) // The property at issue in these proceedings forms part of ZONA PROTECTORA DE LOS CERROS DE ESCAZÚ, which affects Alajuelita, Aserrí, Escazú, Santa Ana, Mora, Acosta, and Puriscal. Under Sala Primera’s position, therefore, all properties in that zone would form part of Patrimonio Natural del Estado and would be INALIENABLE AND WITHIN THE PUBLIC DOMAIN, which would constitute a DE FACTO EXPROPRIATION (expropiación de hecho), AN ACT OF CONFISCATION, and UNJUST ENRICHMENT (enriquecimiento ilícito), in violation of article 45 of Constitución Política and article 21 inciso 2 of Convención Americana de los Derechos Humanos, which provide that PROPERTY IS INVIOLABLE AND NO ONE MAY BE DEPRIVED OF THEIR PROPERTY WITHOUT PRIOR COMPENSATION IN ACCORDANCE WITH THE LAW. // SINAC should never be joined in this type of proceeding, as the Tribunal de Apelaciones de lo Contencioso Administrativo has consistently held, because the relief sought is remedy of the defendants’ failure to act pursuant to article 5 of Ley Indígena. // Moreover, any compensation that may ultimately be awarded in these proceedings would in no way affect the restrictions established by Sistema Nacional de Áreas de Conservación del Minaet. // Nevertheless, in light of this blunder and legal aberration by Sala Primera, and to avoid being LEFT WITHOUT A DEFENSE AND DELAYING the proceedings, my client has no choice but to consent to and request SINAC’s joinder as an INTERESTED THIRD PARTY (tercero interesado), NOT AS A PARTY TO THE PROCEEDINGS, SO AS TO AVOID A POTENTIAL UNJUSTIFIED NULLIFICATION by Honorable Sala Primera de Justicia. // Regarding the JOINDER OF ADI DE QUITIRRISÍ DE MORA in these proceedings, WE OPPOSE AND REJECT its participation as a PARTY or INTERESTED THIRD PARTY because, as explained above, the only entities required to remedy the OMISSIVE CONDUCT PURSUANT TO ARTICLE 5 OF LEY INDÍGENA are INDER and CONAI. // Furthermore, INVERSIONES HIDALGO, as the counterclaimant, has the right and authority to determine against whom it brings its counterclaim (reconvención), as explained below: // FIRST: As can be seen FROM THE RELIEF SOUGHT IN INVERSIONES HIDALGO’S COUNTERCLAIM, which is included in these ordinary proceedings, NONE IS DIRECTED AGAINST ASOCIACIÓN INDÍGENA, and none requests its intervention or the performance of any act.

INDER AND CONAI are the entities that have maintained CONTINUOUS OMISSIVE CONDUCT since 1977 by failing to comply with article 5 Ley Indígena, not Asociación Indígena. // SECOND: The appellant’s interpretation of article 38 CÓDIGO PROCESAL CIVIL is incorrect because that provision establishes the CLAIMANT’S DISCRETION TO ASSERT OR NOT ASSERT A COUNTERCLAIM against the parties it deems necessary, and in this specific case Nombre164051 chooses or determines whom to countersue. // ARTICLE 38.—Counterclaim and reply 38.1 Counterclaim. The defendant may file a counterclaim against the claimant, but only in the pleading answering the complaint, and may join as a counterclaim defendant a person who is not a claimant. // The complaint and counterclaim must be connected or the counterclaim must arise from the outcome of the complaint. The counterclaim must satisfy the same requirements as the complaint.

If it is defective, its correction shall be ordered on the same terms applicable to the complaint. Unless otherwise provided by law, a counterclaim shall be admissible only in ordinary proceedings. (Emphasis and underlining added) // THIRD: To determine the PARTIES TO PROCEEDINGS, reference must be made to ARTICLE 220 CPCA and, on a supplementary basis, to ARTICLE 22 OF THE CÓDIGO PROCESAL CIVIL, which establishes two conditions: // A. A statutory provision // B. Or the nature of the substantive legal relationship (relación jurídica material). // The STATUTORY PROVISION condition does not apply in this case because the LEGALITY OR ILLEGALITY OF AN ADMINISTRATIVE ACT (acto administrativo) IS NOT BEING CHALLENGED under ARTICLE 12 OF CPCA; rather, the relief sought is remedy of OMISSIVE CONDUCT. // Regarding the LEGAL NATURE OF THE SUBSTANTIVE RELATIONSHIP and these ordinary proceedings, article 5 of Ley Indígena clearly establishes that ITCO, now INDER, and CONAI were assigned a series of obligations, APPLICABLE ONLY TO THEM, namely: // ‘With respect to non-indigenous persons who are good-faith owners or possessors within indigenous reserves, I.T.C.O. shall relocate them to other similar lands if they so desire; if relocating them is impossible or if they do not accept relocation, it shall expropriate their properties and compensate them in accordance with the procedures established in Ley de Expropiación.

The studies and procedures for expropriation and compensation shall be carried out by I.T.C.O., in coordination with CONAI.’ Emphasis and underlining added.” // ARTICLE 5 OF THE LEY INDÍGENA creates an ADMINISTRATIVE LEGAL RELATIONSHIP (RELACIÓN JURÍDICA ADMINISTRATIVA) involving only the defendant parties, CONAI AND INDER. // FOURTH: The SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA has also ruled on the issue of which party must participate IN LAND-COMPENSATION PROCEEDINGS WITHIN INDIGENOUS RESERVES (PROCESOS INDEMNIZATORIOS DE TIERRAS DENTRO DE RESERVAS INDÍGENAS), through VOTO NÚMERO 001604-F-S1-2012 DE LAS NUEVE HORAS DEL SEIS DE DICIEMBRE DE DOS MIL DOCE: // In CONSIDERANDO NÚMERO VI: regarding the STATE’S NECESSARY JOINDER (LITISCONSORCIO DEL ESTADO), it states that INDER is an AUTONOMOUS PUBLIC-LAW INSTITUTION WITH LEGAL PERSONALITY, ITS OWN ASSETS, AND ADMINISTRATIVE INDEPENDENCE; therefore, there is no need to involve anyone else, since this is solely an obligation of INDER, in coordination with CONAI. // In CONSIDERANDO VIII, the Chamber is unequivocal IN ITS DIRECT OBJECTION (REPARO DE NATURALEZA DIRECTA), stating: // “It is clear to the Chamber that INDER is responsible, insofar as relevant to this case, for the following functions: 1) relocating good-faith owners or possessors outside the indigenous reserves; and 2) expropriating their properties and compensating them if relocation is not possible.

The particular arrangement devised for funding and administering the fund does not detract from the fact that, in light of the provision, it is clear that the defendant Institute, in coordination with CONAI, is responsible for carrying out the expropriation proceedings (trámites expropiatorios).” (Emphasis added)// For all the foregoing reasons, I hereby submit my response to the appeal filed by INDER." (See digital case file (expediente digital)).

IV. REGARDING THE POSITION OF INVERSIONES HIDALGO ÁLVAREZ S. A.

With respect to joinder of the parties (integración de la litis), the civil co-defendant states:

“I, the undersigned, identified in the record as Special Judicial Attorney-in-Fact (Apoderado Especial Judicial) for INVERSIONES HIDALGO ÁLVAREZ S.A., appear before your Authority, in a timely and proper manner, to respond to the hearing granted in the ruling issued at 11.55 hours on 19 de agosto de los corrientes, concerning the Appeal (Recurso de Apelación) filed by INDER against ruling No. 1310-2022 of 15.25 hours on 9 de agosto pasado, issued orally during the preliminary hearing (audiencia preliminar), as follows: // This representation does not agree with the arguments made by the appellant INDER, since it appears not to be properly assessing the scope of the relief sought in the counterclaim (reconvención), or, in other words, it is overstating that scope beyond the effects sought in these proceedings. Members of this Court, note that what is requested in the counterclaim is compliance with and enforcement of the provisions of artículo 5º, parte primera, of Ley Indígena No. 6172 and, specifically, that Inder, in coordination with CONAI, conduct the expropriation studies and procedures (trámites de expropiación) in order to establish the amount of compensation that would be paid to my client.

Accordingly, it is not true that there is any substantive or functional legal relationship between the claims in the counterclaim and the ESTADO, nor with the Asociación de Desarrollo Integral Indígena de Quitirrisí.// It is clear that if the counterclaim were ultimately upheld in these proceedings, expropriation proceedings (proceso de Expropiación) would then have to be initiated, in which the State—because of the compensation determined and payable—and the aforementioned Association would probably be parties. However, in this case file, considering the claims asserted in the counterclaim filed, it is not necessary to join the State or the Asociación de Desarrollo Integral Indígena de Quitirrisí as parties, because, I reiterate, they have no substantive or functional legal relationship with the claims asserted. The representative of the appellant INDER is therefore incorrect, and consequently, the appeal must be dismissed in those respects. // Regarding the aforementioned Association, it should be added that the fact that it may ultimately become the owner of the real property of which my client is currently the registered owner and the actual and effective possessor does not mean that a counterclaim must be brought against it.

That circumstance is simply an effect of any expropriation—in the best-case scenario—or confiscation—in the worst-case scenario—that my client may suffer because the real property is located within the area designated as Reserva Indígena de Quitirrisí. In my professional opinion, and irrespective of what was decided at the time in ruling No. 106-2013- I of the Tribunal Contencioso Administrativo, expediente No. 07-001117-0163-CA—cited by the appellant—it is not true that the Asociaciones de Desarrollo Indígena have a role, as such, in the processes for analyzing and determining expropriations, because we are discussing real property that has never previously been expropriated, and that obligation, under artículo 5º of Ley Indígena itself, rests with CONAI. // Lastly, regarding the appellant’s arguments in support of its claim that the State must be joined as a party, I must point out that, although they are understandable given the economic implications involved, this is neither the proper time nor the proper proceeding in which to assert them. // Regarding the need to join the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC) as a party, I also request that the appeal filed be dismissed because, although an area of my client’s property was affected by Decreto Ejecutivo No. 6112 published on 17 de julio de 1976—which delimited Zona Protectora El Rodeo—and was subsequently expanded by Decreto Ejecutivo No. 14672 published on 21 de julio de 1983—which delimited Zona Protectora Cerros de Escazú—the truth is that this designation entails only subjecting that portion of the property to the forestry regime (régimen forestal), without thereby causing the private right of ownership or title over it to be lost or transferred to the administration of SINAC.

It is clear that submission to the forestry regime entails a restriction on the irrational exploitation of existing forest resources and, instead, protection of those resources—a protected area (zona protegida)—particularly since, as was duly demonstrated through the documentary evidence submitted with the counterclaim, evidence No. 5 a 16, the registrations of the registered properties comprising what is now the property of Partido de San José, matrícula No. Placa33488, historically date back to times well before the promulgation of the two executive decrees mentioned above. Therefore, the interests of SINAC are not affected in any way. // Furthermore, it is important to recount the provisions of artículo 3º of Decreto Ejecutivo No. 6112, which reads: ‘Properties duly registered with the Registro Público or protected by ten-year possession (posesión decenal) within the boundaries of the protected zones shall automatically be subject to the forestry regime.

Any work to be performed on these properties must have the written authorization of the Dirección General Forestal.’ (Emphasis not in the original). // Likewise, artículo 2º of Decreto Ejecutivo No. Placa33489 contains similar language, providing that: ‘Real properties—state-owned and privately owned—located within the boundaries specified in the preceding article shall be mandatorily subject to the forestry regime. Consequently, only work that has the prior written authorization of the Dirección General Forestal may be performed in those areas.’ (Emphasis not in the original). // It is clear from both provisions that the designation of an area of my client’s property as a protected area by the Executive Decrees that established Zona Protectora El Rodeo and Zona de Protección de los Cerros de Escazú does not entail placing that area in the public domain (afectación demanial), but merely subjecting it to the forestry regime.

In other words, it is a restriction on the right of ownership intended to rationalize the use of the existing forest resources there—note that the assets subject to this regime do not become part of the public domain, but remain within the private owner’s estate. Consequently, because there is no substantive relationship between the relief sought in the counterclaim and any potential effect, amendment, or declaration concerning the aforementioned forestry regime, the objection based on failure to join SINAC as a necessary passive co-litigant (litis consorcio pasivo necesario) must be denied. // In conclusion, I request that the Appeal filed be dismissed in its entirety and that ruling No. 1310-2022 of 15.25 hours on 9 de agosto del 2022, issued by the Tribunal Contencioso Administrativo of this circuit during the preliminary hearing held that day, be affirmed” (See digital case file).

V: REGARDING PASSIVE JOINDER OF PARTIES (LITIS CONSORCIO PASIVO): With respect to the possible existence of joinder of parties (litis consorcio), it is appropriate to refer to ruling number 18 of the Sala Primera, issued at 14:30 hours on 27 de abril de 1994, which stated:

“… IV.- Joinder of parties (litisconsorcio) is one of the procedural forms involving multiple parties and is characterized by placing a third party (or third parties) in a common relationship with one of the parties, whether the plaintiff or the defendant, involving the same subject matter and the same cause of action (causa petendi), such that the plaintiff could have brought the action against the third party directly or jointly with the defendant (passive joinder of parties [litisconsorcio pasivo]), or several parties may have the same claim against another party (active joinder of parties [litisconsorcio activo]) or other parties (mixed joinder of parties [litisconsorcio mixto]). Co-litigants (litisconsortes) may participate in two ways: permissively or necessarily. Permissive joinder applies when an action is brought jointly by persons with the same claims arising from the same title or based on the same cause, or when the person holding the claim directs it against all those who must answer for it.

Necessary joinder, in turn, occurs when, by operation of law or because of the nature of the legal relationship, the persons affected by the ruling are required to act jointly as co-litigants, so that they are bound by the proceedings and, consequently, by the effects of the judgment. V.- Necessary joinder presupposes that all persons who would be affected by the resolution of the matter must be present in the proceedings; hence the authority granted to the Judge to declare the existence of necessary joinder ex officio, meaning that it is not merely a preliminary defense (artículo 298 Código Procesal Civil vigente) available only to the defendant. The judge may effect the necessary joinder .., and pursuant to the ... same body of law, the judge is responsible, as a procedural remedial measure (medida de saneamiento), from the admission of the complaint and at the appropriate stages, for effecting necessary joinder.

Necessary joinder entails the existence of substantive legal relationships concerning which it is impossible to rule by dividing them or assessing them solely in relation to some of their parties, because the decision encompasses and binds them all. The presence of all parties is indispensable for the procedural relationship to be complete and for a judgment on the merits to be rendered (Sala Primera de la Corte número 72 de 15 horas del 3 setiembre 1982). The repealed Código de Procedimientos Civiles contained no express provision concerning necessary passive joinder; nevertheless, through interpretation of artículo 1º párrafo in fine of that body of law, it was traditionally considered to regulate indirectly active and passive standing (legitimatio ad causam activa y pasiva) and the form thereof involving necessary joinder.” Artículo 66 inciso 1), of Código Procesal Contencioso Administrativo, establishes as a ground for the inadmissibility of a complaint, in relation to ordinal provisions 58 and 61 ibídem, that the pleadings initiating the action contain formal defects that prevent a ruling on the merits; among those defects, the case law has identified necessary passive joinder.

This situation arises when, in order to render judgment, the judgment must be directed against a person who has not appeared in the case because the plaintiff failed to move for that person’s participation; that is, when the ruling must affect the rights or interests of someone who has not been brought into the proceedings so that the person may learn of them and, at the appropriate time, defend their position. Legal scholarship has regarded such a situation in terms identical to those used in the case law, identifying it as “the plurality of principal parties, joined in their procedural actions, whether plaintiffs (active joinder), defendants (passive joinder), or plaintiffs and defendants (mixed joinder)” [Nombre31309 (Nombre304), Comentarios a la Ley de Jurisdicción Contencioso Administrativa, Madrid, Editorial Civitas, 1ra.Edic., 1978, pag.463]. Thus, necessary passive joinder refers to the imperative need for all persons who could ultimately be affected by the judicial decision on the merits to appear as defendants in the proceedings. This doctrine is governed by artículo 22 of Código Procesal Civil vigente, which provides:

“ARTICLE 22.- Plurality of parties and persons 22.1. Compulsory joinder (litisconsorcio necesario). When, by operation of law or because of the nature of the substantive legal relationship (relación jurídica material), the decision must involve several persons, they must sue or be sued in the same proceeding.// The courts shall order the party, within five days, to expand its complaint or counterclaim to include those who are absent, with the warning that the proceeding will be terminated with respect to the complaint or counterclaim, as applicable. // When completing the joinder of parties (integrar la litis), the plaintiff may add to the allegations in the initial complaint only such additional allegations as are indispensable to justify the claims against the new defendants, without substantially altering the relief sought. " The Código Procesal Contencioso Administrativo says little about the substantive legal relationship, but with regard to joinder by operation of law, Article twelve of that body of law provides:

"ARTICLE 12.- The following shall be deemed defendants:

  • 1)The Public Administration that issued the administrative conduct (conducta administrativa) at issue in the proceeding, except when the Executive, Legislative, or Judicial Branch or the Tribunal Supremo de Elecciones is involved; in such cases, the State shall be sued.
  • 2)Administrative bodies having instrumental legal personality (personalidad jurídica instrumental), insofar as they issued the administrative conduct at issue in the proceeding, jointly with the State or the entity to which they are attached.
  • 3)Natural or legal persons who have derived rights and legitimate interests (intereses legítimos) from the administrative conduct at issue in the proceeding.
  • 4)Any other person who has been joined in the proceeding as a responsible party, in a functional or personal capacity.
  • 5)The Contraloría General de la República:
  • a)Jointly with the State, when the proceeding concerns its administrative conduct related to the exercise of its constitutional and statutory authority.
  • b)Jointly with the audited entity, when the proceeding concerns administrative conduct subject to its oversight in the exercise of its supervisory powers or its superior guardianship of the Public Treasury (Hacienda Pública).
  • 6)When an entity issues an act or provision that, in order to become final, requires prior review, authorization, approval, or acknowledgment by a State body or another administrative entity, the following shall be deemed a defendant:
  • a)The State or the entity that issued the reviewed act or provision, if the outcome of the review was approval.
  • b)The entity that conducted the review, if it did not approve the act or provision.
  • 7)When an entity issues an act or provision that, by virtue of a non-hierarchical administrative appeal (recurso administrativo no jerárquico)—whether optional or mandatory—must be heard by a State body or another administrative entity, the following shall be deemed a defendant:
  • a)The State or the entity that issued the act, when the act has been upheld.
  • b)The entity that, upon hearing the appeal, annuls, revokes, or modifies the challenged conduct.
  • 8)If the plaintiff bases its claims on the unlawfulness of a general provision, the Administration that issued that provision shall also be deemed a defendant, even if the challenged action did not originate from it." Now, as already noted, depending on the case, joinder may be simple or permissive (facultativa) when it results from the parties’ wishes, or compulsory when it results from a statutory mandate. On this subject, the Sala Primera de la Corte Suprema de Justicia has held:

"I.- Depending on their underlying circumstances, all proceedings may involve multiple parties—a plural or multiple procedural relationship (relación procesal plural o múltiple)—which may take either of two forms: plurality by coordination, where the parties are on the same level, or plurality by subordination, where they are not. The former encompasses two important concepts within procedural practice: joinder of parties (litisconsorcio) and third-party intervention (intervención de terceros); plurality by subordination includes supporting intervention (participación coadyuvante). Various types or classes of third-party intervention may be identified, namely: a) Voluntary intervention (intervención voluntaria): when participation in the proceeding results solely from the third party’s own volition and that party has an interest adverse to one or both parties (meaning the plaintiff or defendant); b) Adhesive intervention (intervención adhesiva): when the person enters the proceeding or is joined in it to intervene in support of one of the parties; and c) Compulsory intervention (intervención obligada): involving third parties whose rights may be characterized as parallel to those of the plaintiff or defendant.

II.- Joinder of parties is one of the procedural forms of subjective plurality (pluralidad subjetiva), characterized by placing the third party (or parties) in a common relationship with one of the parties, whether the plaintiff or defendant, involving the same subject matter and the same cause of action (causa petendi), such that the plaintiff could have brought the action against the third party directly or jointly with the defendant (passive joinder (litisconsorcio pasivo)), or several persons have the same claim against another person (active joinder (litisconsorcio activo)) or others (mixed joinder (litisconsorcio mixto)). The participation of joined parties (litisconsortes) may occur in two ways: permissively or compulsorily. Permissive joinder applies when an action is brought jointly by persons whose claims arise from the same legal basis or are founded on the same cause, or when the person asserting the claim brings it against all those who must answer for it.

Compulsory joinder, in turn, occurs when, by operation of law or because of the nature of the legal relationship, the persons affected by the ruling must act jointly as joined parties, so that they are bound by the proceeding and, consequently, by the effects of the judgment." (Sala Primera de la Corte Suprema de Justicia, Nº 72 de las 15:00 horas del 13 de setiembre de 1982).- Depending on the particular circumstances, joinder may be simple or permissive when it results from the parties’ wishes, or compulsory when it results from a statutory mandate. On this subject, the Sala Primera de la Corte Suprema de Justicia has held:

"I.- Depending on their underlying circumstances, all proceedings may involve multiple parties—a plural or multiple procedural relationship—which may take either of two forms: plurality by coordination, where the parties are on the same level, or plurality by subordination, where they are not. The former encompasses two important concepts within procedural practice: joinder of parties and third-party intervention; plurality by subordination includes supporting intervention. Various types or classes of third-party intervention may be identified, namely: a) Voluntary intervention: when participation in the proceeding results solely from the third party’s own volition and that party has an interest adverse to one or both parties (meaning the plaintiff or defendant); b) Adhesive intervention: when the person enters the proceeding or is joined in it to intervene in support of one of the parties; and c) Compulsory intervention: involving third parties whose rights may be characterized as parallel to those of the plaintiff or defendant.

Permissive joinder applies when an action is brought jointly by persons whose claims arise from the same legal basis or are founded on the same cause, or when the person asserting the claim brings it against all those who must answer for it. Compulsory joinder, in turn, occurs when, by operation of law or because of the nature of the legal relationship, the persons affected by the ruling must act jointly as joined parties, so that they are bound by the proceeding and, consequently, by the effects of the judgment." (Sala Primera de la Corte Suprema de Justicia, Nº 72 de las 15:00 horas del 13 de setiembre de 1982).- It should also be noted that, in civil proceedings involving the Public Treasury (procesos civiles de hacienda), case law has repeatedly held that completion of joinder (integración de la litis) is not permissible except by operation of law, because the right to bring an action is a right and, as such, the party chooses the natural or legal person against whom to bring the action, thereby assuming the consequences of that decision. Requiring a different person to be joined would violate the party’s right to choose the person against whom that right is exercised.

VI: ON THE MERITS: The issue brought forward for discussion by the Instituto de Desarrollo Rural has been considered on multiple occasions by this Court, in both Chambers and under different compositions; and although it initially generated some conflicting rulings, in recent years the outcome has been consistent, even though there has always been a dissenting vote. As a first point, the party argues that although, technically, the proceeding is not a civil proceeding involving the Public Treasury (proceso civil de hacienda), under Article twelve, subsections three and four, in relation to Article twenty-two of the Código Procesal Civil (although Article one hundred six of the same body of law, which was repealed four years ago, is cited), the parties must be joined (integrarse la litis). With respect to civil proceedings involving the Public Treasury, this Chamber has repeatedly held that the claimant determines against whom the action is brought and assumes the positive or negative consequences of that decision; none of the provisions cited above apply, except where joinder is required by operation of law.

From that standpoint, it is not possible to order joinder as sought by the respondent, a matter that has already been explained to it on previous occasions. We therefore see no need to revisit the issue when the entity itself acknowledges the existence of that position but simply disagrees with it and, adopting a position convenient to its interests, maintains that it should not apply. In that regard, it has been explained that the source of the funds and joinder are two very different matters. The claim will be granted if, in the judgment court’s view, the merits of the record so warrant. Whether the money needed to pay any compensation must come from INDER’s own revenues, or whether it must undertake the customary coordination with the central State and thereby seek the inclusion of an appropriation in the national budget, is a matter of neither interest nor relevance to the claimant or the counterclaimant, but rather an issue pertaining to administrative coordination.

The only party interested in simplifying that procedure is INDER, which does not wish to be subjected to it. Consequently, this ground of appeal is unfounded and must be rejected. The arguments advanced under this ground of appeal maintain, for various reasons set forth by the appellant entity, that the complaint or counterclaim should have been directed against the State rather than against the respondents. Although both issues are interesting, their determination falls to the judgment court, whether on the basis of lack of standing to sue, lack of standing to be sued, or absence of a right; for, as stated, other factors determine whether joinder is required, and those arguments must therefore be rejected. That aside, the appellant argues in its statement of grounds for appeal, in summary, that the State must participate in the proceeding because it is the party that will ultimately provide the funds used to satisfy the relief sought and must also ensure that those funds are not diverted from their intended purpose by paying for lands that should not be compensated with that money, as well as verify that the person benefiting from the judgment is genuinely entitled to the relief requested.

This Court disagrees with the appellant entity’s position, taking into consideration that the claimant’s requested relief and theory of the case involve an obligation to perform (obligación de hacer), arising from a claim based on the omission of required conduct, together with a civil matter involving the Public Treasury that translates into compensation for damages (daños y perjuicios), the latter forming the basis of the counterclaim. The claimant’s position, within a typical liability context, is that INDER is responsible for the administrative conduct and also for its financial consequences under the Ley Indígena. The underlying dispute—which must be resolved in the judgment—concerns an unpaid amount arising from an obligation to perform that is alleged to have been breached. In that context, the claimant and the counterclaimant elected to demand what was owed exclusively from those already named as defendants.

As previously noted, the source of the funds with which the relief sought by the claimant must be paid is a matter of administrative coordination; the appellant seeks to bring the State into the proceeding solely to avoid that activity, which makes no legal sense. The Sala Primera has also defined this doctrine for cases such as the present one, stating: “VI.- (...) Ley no. 2825 of 8 de diciembre de 1962 created the Instituto de Tierras y Colonización. Through Ley no.6735 of 29 de marzo de 1982, that Institute was transformed into the Instituto de Desarrollo Agrario, which was defined in its Article 1 as an ‘autonomous public-law institution, with legal personality, its own assets, and administrative independence.’ That law, in turn, was recently amended, as Ley no. 9036 of 29 de mayo de 2012 transformed IDA into the Instituto de Desarrollo Rural (INDER), but its Article 14 literally retained the provision transcribed above; that is, it constitutes an autonomous public-law institution, with legal personality, its own assets, and administrative independence.

As an autonomous institution, and given that, pursuant to Article 5 cited above, it is responsible for the expropriation (expropiación) of lands located in indigenous reserves that are possessed or owned by non-indigenous persons, there is clearly no need to involve the State in the litigation, since the exercise of the authority whose omission was alleged by the claimant (who has not been expropriated) falls to INDER in coordination with CONAI, not to the State. The fact that the incorporation of the territories into the reserve was ordered by decree does not alter what has been stated thus far, because INDER, in coordination with CONAI, must assume the powers conferred by law for the protection of such lands, which are intended to safeguard the indigenous population. Accordingly, the alleged defect in joining the State as a party is not established” (SALA PRIMERA. Voto N° 001604-F-S1-2012 DE 9:00 horas de 6 de diciembre de 2012).

INDER invokes in its favor a series of rulings by the Tribunal Contencioso Administrativo and the Sala Primera. As to the former, it should be clarified that we respect those positions but do not share them; as to the Sala Primera de la Corte Suprema de Justicia, one of the case files does not concern the circumstances now before us, and the remaining rulings reflect positions abandoned several years ago. The cited judicial precedents are therefore unpersuasive and must be rejected. Regarding the joinder of the asociación de desarrollo Integral de la Reserva Indígena de Quitirrisí de Mora, it is argued that its participation is required because the amount of land it must administer could increase. In this respect, the Court can appreciate that the decision may affect additional indigenous groups. However, it must be recalled that indigenous lands are, in principle, public-domain property (bienes demaniales) and that, consequently, the various public entities—or even private entities, as in the case of associations of indigenous peoples—are merely administrators of such property.

CONAI is represented in the case file and is charged with undertaking all actions for the benefit of all indigenous groups, without prejudice to the actions those groups may pursue on their own behalf. In those terms, this ground of appeal is entirely without merit. Lastly, as regards the Sistema Nacional de Áreas de Conservación, it is no secret that most indigenous territories are subject to two distinct protective designations (doble afectación). One is environmental, insofar as these human groups live in greater harmony with their surroundings, fostering the proliferation of the flora and fauna native to the area and thereby playing a predominant role in maintaining environmental balance. The other concerns their way of life, which encompasses a millennia-old culture deserving of respect. In that regard, should the claimant’s action succeed, nothing would prevent the State from eventually assessing property dedicated to the public domain from both perspectives.

Nor does this prevent SINAC, if it has conducted studies and concluded that a different designation should be imposed, from bringing whatever action it deems appropriate through the corresponding proceeding, without any need to join it in the present case. Returning to the basis for joinder, as stated in the preceding recital (considerando), it is supported on only two grounds. The first is the substantive legal relationship (relación jurídico material), which is derived from the statement of facts and the relief sought, neither of which is directed against the State, the Sistema Nacional de Áreas de Conservación, or the Asociación sought to be included as a respondent in either the action or the counterclaim. There is therefore no basis for modifying the decision. The other ground arises when joinder is required by operation of law, but no provision has been identified with respect to the State, the Sistema Nacional de Áreas de Conservación, or the Asociación that supports such an assertion.

The Asociación clearly has an interest in the return of the lands at issue, but the existence of the expropriation and any potential payment on that basis are matters of indirect or no relevance. The representation sought for the entity representing the indigenous peoples is already provided by operation of law, and it therefore need not enter an appearance in the proceeding. As previously noted, the remaining arguments do not warrant modifying the decision, because the grounds for mandatory joinder of defendants (integración pasiva necesaria) are not the same as those that permit a complaint to be directed against one party or another; those arguments must therefore be rejected. In view of the foregoing, the decision under appeal is affirmed.

VII: DISSENTING OPINION OF JUDGE GONZÁLEZ VÍLCHEZ: With respect for my colleagues, I dissent solely because I consider that the State must be a defendant in this matter. This conclusion is based on Article 5 of Ley Indígena, N°6172, which establishes that any compensation payable under that law shall be paid through the general budgets of the Republic. In my view, this means that the State must be present in proceedings of this type in the event that the claim is ultimately granted. Consequently, I partially grant the appeal and order that the State be joined.

POR TANTO:

As to the matter under appeal, the appeal filed is denied, and the order under review is affirmed. Judge González Vilchez dissents solely with respect to the joinder of the State. ASUNTO: PROCESO DE CONOCIMIENTO ACTOR: ASOCIACIÓN DE DESARROLLO INTEGRAL DE LA RESERVA INDÍGENA DE QUITIRRISÍ DEMANDADO: COMISIÓN NACIONAL DE ASUNTOS INDÍGENAS, INSTITUTO DE DESARROLLO RURAL E INVERSIONES HIDALGO ÁLVAREZ S. A.

N° 0424-2022-II TRIBUNAL DE APELACIONES DE CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. Segundo Circuito Judicial de San José, Dirección19654 . , a las siete horas treinta minutos del veinticinco de noviembre de dos mil veintidós.

Excepción de falta de integración del litis consorcio pasivo necesario, dentro del proceso de conocimiento establecido por la ASOCIACIÓN DE DESARROLLO INTEGRAL DE LA RESERVA INDÍGENA DE QUITIRRISÍ contra la COMISIÓN NACIONAL DE ASUNTOS INDÍGENAS, INSTITUTO DE DESARROLLO RURAL (en adelante INDER) E Nombre164051 . . con reconvención de Nombre164051 . . contra el INSTITUTO DE DESARROLLO RURAL. Se conoce recurso de apelación en contra del auto número 1310-2022 de las 15:25 del nueve de agosto de dos mil veintidós, del Tribunal de lo Contencioso Administrativo y Civil de Hacienda.

CONSIDERANDO:

I. SOBRE LOS HECHOS PROBADOS

Para el dictado de esta resolución se tiene por acreditado lo siguiente: "A) La representación del Instituto de Desarrollo Rural interpuso la defensa de Indebida integración de la litis, pidiendo fuera integrados al proceso, la la Asociación de Desarrollo Integral de Quitirrisí de Mora, El Estado y el Sistema Nacional de Áreas de Conservación (Ver expediente electrónico). B) Mediante resolución 1310-2022 de las quince horas con veinticinco minutos de nueve de agosto de dos mil veintidós, del Tribunal Contencioso Administrativo resolvió: "Se rechaza la defensa previa de integración de litis consorcio pasivo necesaria interpuesta por la representación del INDER" (Ver expediente electrónico). C) Frente a esta determinación la representación del INDER interpuso recurso de apelación (Ver expediente electrónico). D) Por resolución de las once horas cincuenta y cinco minutos del diecinueve de agosto de dos mil veintidós (Ver expediente digital).

II. SOBRE LOS MOTIVOS DEL RECURSO

Como fundamento del recurso, expone el apelante:

"Si bien, según parte de la corriente jurisprudencial, al ser un proceso Civil de Hacienda, el actor tiene la facultad de demandar a quien le interese, lo cierto es que la ley de fondo y formal en materia de territorios indígenas, ya establece expresamente responsabilidades y funciones a cada institución Estatal y al Estado mismo. // Por su parte, el instituto del litis consorcio procura garantizar la correcta formación del contradictorio procesal ya que al ser indivisible la relación sustancial, es indispensable en lo que ataña a la parte demandada, que al proceso concurran todos los sujetos a quienes corresponda contradecir la pretensión deducida. // De manera que, con fundamento en los artículos 12 incisos 3 y 4 CPCA + 106 C. Procesal Civil que establece la necesidad de integrara la litis cuando .... En virtud de que existe una relación jurídica material entre las pretensiones de la demanda y el carácter funcional de las partes que se pretende integrar es que, deriva la importancia de la litis consorcio se integre debidamente, toda vez que de lo contrario no podrá conocerse el fondo del asunto. // A) CON RESPECTO AL ESTADO: A través del tiempo, en el trámite judicial de los procesos de esta naturaleza relacionadas a territorios indígenas y solicitud de trámite de proceso expropiatorio, han sido constantes las tesis antagónicas de las partes, donde: los particulares, se mantiene que existe una responsabilidad compartida del INDER, CONAI (y en algunos casos, hasta si ha sido incluido el Estado) por la omisión de iniciar aquel tramite del proceso expropiatorio, el cual incluye todas las etapas; medicación, avaluó y pago, mientras que, tanto el INDER como el CONAI, se mantiene y han defendido repetidamente (en todas las etapas procesales de muchos casos judiciales) que -con relación a temas indígenas- la ley ya expresamente define responsabilidades y funciones a cada institucional estatal y al Estado tal cual. // De manera que, si bien podría existir responsabilidad en los tramites expropiatorios (que incluye mediación, censos, avalúos, entre otros), esta responsabilidad administrativa se cumple por parte del INDER, cuando a nivel institucional nace un estandarte nacional y, se pone en marca desde marzo de 2016, el denominado Plan de Recuperación de Territorios Indígenas (en adelante Plan-RTI) en donde su objetivo principal es realizar aquellos tramites expropiatorios para la recuperación de esos terrenos, los cuales serían:

  • 1)el levantamiento de información,
  • 2)amojonamiento,
  • 3)Consensos,
  • 4)levantamiento topográfico. Lo cierto es que estos trámites expropiatorios no incluyen y no existe obligación en la relación del pago utilizando su propio presupuesto, pues es al EStado a quien, por disposición de la ley, se le establece las responsabilidades de: a) la obligación de inscripción en el Registro Público las reservas indígenas (de conformidad con el artículo 2 de la Ley Indígena). b) y la obligación de financiar y pagar las indemnizaciones (de conformidad con el artículo 5 de la Ley indígena y de la Ley de Expropiaciones). por su parte, la ley indígena en el artículo 5 establece: .... Como se desprende de la normativa supra citada, el artículo 5 de la Ley Indígena No. 6172, establece que los estudios y trámites de expropiación e indemnización en territorio indígena serán efectuados por el Instituto de Desarrollo Agrario actual Instituto de desarrollo Rural en coordinación con la CONAI, lo cierto del caso es que el artículo 5 es claro que también al establecer en el párrafo tercero que dichas expropiaciones e indemnizaciones serán financiadas por el Estado, por lo que el pago de las expropiaciones deberá realizarlo el Estado. Es decir, al INDER únicamente le corresponde reubicar, expropiar, coordinar, no pagar, como se pretende. // Es el Estado Costarricense quien tiene la obligación legal de aportar los recursos económicos como creadora de los territorios indígenas, rechazo lo indicado por el respetable tribunal que en caso de salir condenado el INDER debe asumir costos económicos de una sentencia condenatoria es temerario y bien es conocida la insolvencia económica institucional para hacer frente a estas demandas de los territorios indígenas. ..... Como lo indico la CGR el INDER está en un eminente peligro financiero ante la posibilidad de que se tenga que hacer erogaciones dinerarias por pago de las tierras sometidas a a territorios indígenas, es indispensable que se tenga como demandado en este proceso y en todos los que se tramitan en el Contencioso Administrativo al Estado..... De manera que, en virtud de que existe una relación jurídico material entre las pretensiones de la demanda y el carácter funcional del Estado quien es responsable de pagar o financiar esas indemnizaciones, se deriva la importancia de que la litis consorcio se integre debidamente, toda vez que de lo contrario no podrá conocederse el fondo del asunto. ...b) CON RESPECTO A LA ASOCIACIÓN DE DESARROLLO INTEGRAL DE LA RESERVA INDÍGENA DE QUITIRRISÍ DE mORA (ADI) // En relación con la ADI es imprescindible que la comunidad indígena y resulta evidentemente afectadas por las pretensiones del reconventor y la eventual determinación de un derecho a su favor pues ello podrá resultar en aumento de la cabida de los terrenos sobre los cuales ejercer posesión efectiva y les corresponder recibir y administrar; además surge una circunstancia particular en relación con su integración al proceso y es que al ser la ADI la parte actora (en la demanda principal) y hacerse integrado a la reconventora Nombre164051 . A. como codemandada ... a fin de lograr la identidad de las partes, debe Nombre164051 dirigir sus pretensiones hacia la ADI, tal como lo dispone el artículo 106 CPC.... d) CON RESPECTO AL SINAC: Siendo que el informe técnico AT-647-2015 concluye que existe afectación por la zona protectora de rodeo, resulta importante traer el proceso al SINAC para que valide la no afectación a sus intereses; téngase presente que, ni el INDER ni ninguno de los particulares de este proceso tiene la capacidad de determinar la afectación a Patrimonio Nacional del Estad, y por la naturaleza misma de los terrenos resulta importante este análisis por parte de la entidad competente. " (Ver expediente digital).

III. SOBRE LA POSICIÓN DE LA PARTE ASOCIACIÓN

Expone la representación de la asociación con respecto al punto:

"Respecto a la INCORPORACIÓN DEL ESTADO en el presente proceso debe rechazarse por lo siguiente: // PRIMERO: Para poder determinar las PARTES DENTRO DE UN PROCESO, se debe recurrir al ARTÍCULO 220 CPCA y en forma supletoria al ARTÍCULO 22 DEL CÓDIGO PROCESAL CIVIL, el cual nos habla de dos presupuestos: // SEGUNDO: La SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA ha resuelto también éste tema de la participación del Estado EN PROCESOS INDEMNIZATORIOS DE TIERRAS DENTRO DE RESERVAS INDÍGENAS, lo anterior mediante el VOTO NÚMERO 001604-F-S1-2012 DE LAS NUEVE HORAS DEL SEIS DE DICIEMBRE DE DOS MIL DOCE:// En su CONSIDERANDO NÚMERO VI: en torno AL LITISCONSORCIO DEL ESTADO señala que el Inder es una INSTITUCIÓN AUTÓNOMA, DE DERECHO PÚBLICO, CON PERSONALIDAD JURÍDICA, PATRIMONIO PROPIO E INDEPENDENCIA ADMINISTRATIVA por lo que no existe necesidad de involucrar al Estado, ya que únicamente es un obligación del INDER en coordinación con CONAI En EL CONSIDERANDO VIII la Sala es contundente: EN SU REPARO DE NATURALEZA DIRECTA al señalar: // “para la Sala es diáfano que corresponden al INDER, en lo que resulta de interés para este caso, las siguientes funciones: 1) reubicar a propietarios o poseedores de buena fe fuera de las reservas indígenas y; 2) expropiarlas e indemnizarlas si la reubicación no fuera posible.

La particular forma que se ideó para la dotación financiera del fondo y su administración, no demérita que a la luz de la norma es claro que corresponde al Instituto demandado, en coordinación con el CONAI, realizar los trámites expropiatorios.” (La negrilla es nuestra) // La Sala Primera lo reafirma nuevamente con el VOTO NÚMERO 1443 DE LAS 13 HORAS 50 MINUTOS DEL 23 DE NOVIEMBRE DEL 2017, en su CONSIDERANDO V Y VI, donde señala el mismo argumento y al final indica: // “al no existir razones para variar de criterio, al constituir la Ley no. 6172 una normativa especial que le confiere el deber indemnizatorio al Inder y a la Conai; así como por las razones ya indicadas, el reparo en estudio, en cuanto a la integración de la litis con el Estado, debe ser denegado.” (La negrilla es nuestra) // TERCERO: Se puede apreciar EN LAS PRETENSIONES DE LA DEMANDA que se incluyen dentro del presente Proceso de Conocimiento, NINGUNA VA DIRIGIDA CONTRA EL ESTADO, en ninguna se solicita su intervención o la realización de alguna conducta.Son el INDER Y LA CONAI, las que mantienen una CONDUCTA OMISIVA CONTINUA desde 1977, no así el ESTADO.

Lo que se está solicitando en este proceso ES EL CUMPLIMIENTO DE UNA CONDUCTA OMISIVA DE PARTE DE CONAI Y EL INDER CONFORME EL ARTÍCULO 5 DE LA LEY INDÍGENA Y EL ARTÍCULO 35 CPCA // CUARTO: Como consta en el expediente estamos ante un PROCESO CIVIL DE HACIENDA donde únicamente se viene a DILUCIDAR ASPECTOS ESTRICTAMENTE PATRIMONIALES O PECUNIARIOS de la administración por el INCUMPLIMIENTO DE UNA CONDUCTA OMISIVA, por lo que la parte actora tiene la potestad de decidir a quién demanda y esta no tiene interés de que participe el Estado por lo anteriormente señalado en los puntos anteriores. // Respecto a la INCORPORACIÓN DEL SINAC en el presente proceso: // Con el fundamento legal anteriormente señalados y antecedentes jurisprudenciales, NI EL ESTADO, NI EL SINAC, NI NINGUNA OTRA INSTITUCIÒN DEBERÍAN incorporarse al presente proceso ya que lo que se solicita es el cumplimiento de UNA CONDUCTA OMISIVA CONFORME EL ARTÍCULO 5 LEY DE ASOCIACIONES, pero lamentablemente la Sala Primera de la Corte Suprema de Justicia en el VOTO 001250-F-S1-2021 de las once horas cuarenta y cinco minutos del diecisiete de agosto del dos mil veintiuno señaló lo contrario. // En dicho voto la Sala anula una sentencia a favor de una persona propietaria registral y anterior a Ley Indígena al considerar que hay una INDEBIDA COMPOSICIÓN DE LA LITIS al indicar que debe incorporarse al SINAC ya que las propiedades que se encuentran en ZONAS PROTECTORAS como el caso de la Zona Protectora Cerros de Escazú donde está la propiedad objeto del presente proceso, forman parte de parte del PATRIMONIO NATURAL DEL ESTADO como un bien de dominio público cuya conservación y administración están encomendadas por ley, al Ministerio del Ambiente y Energía, mediante el Sistema Nacional de Áreas de Conservación SINAC. // “Nótese que, el Área de Topografía del Inder, (folios 59 y 60 del expediente judicial) determinó que por medio del Oficio AT- 356-2014 del 05 de agosto 2014, que el plano SJ-1289536-2008-terreno que estaba discutiendo el actor, se encuentra afectado por el Área Silvestre Protegida Zona Protectora Cerros de Escazú.

Es decir, que dicha Zona Protectora forma parte del Patrimonio Natural del Estado como un bien de dominio público cuya conservación y administración están encomendadas por ley, al Ministerio del Ambiente y Energía, mediante el Sistema Nacional de Áreas de Conservación , SINAC, ….” (la negrilla y el subrayado es nuestro). // La Sala Primera al anular la sentencia fundamentado en lo arriba indicado comete un error muy grave y muy preocupante especialmente por ser el mayor tribunal del Poder Judicial respecto a ésta materia al considerar que Patrimonio Natural del Estado y Zona Protectora son lo mismo, lo cual es erróneo como paso a exlicar: // El PATRIMONIO NATURAL DEL ESTADO según el ARTICULO 13 LEY FORESTAL está constituido por los bosques y terrenos forestales de las reservas nacionales, pertenecientes al Estado, Municipalidades, Instituciones Autónomas y demás organismos de la Administración Pública, SON ÁREAS DECLARADAS INALIENABLES Y DE DOMINIO PÚBLICO QUE PERTENECEN AL ESTADO. // Así lo dice artículo 13 de la LEY FORESTAL 7575 indica: “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública,(la negrilla y el subrayado es nuestro).” // Por otro lado ZONA PROTECTORA son los bosques y terrenos de aptitud forestal que son de DOMINIO PRIVADO YA QUE TIENEN PROPIETARIOS PRIVADOS Y DEFINIDOS EN EL REGISTRO PÚBLICO, sometidas a un régimen forestal para regular la conservación, renovación, aprovechamiento de los recursos forestales y así lo señala el ARTÍCULO 37 DE LA LEY DEL AMBIENTE : // “Las fincas particulares afectadas según lo dispuesto por este artículo, por encontrarse en parques nacionales, reservas biológicas, refugios de vida silvestre, reservas forestales y zonas protectoras, quedarán comprendidas dentro de las áreas protegidas estatales solo a partir del momento en que se hayan pagado o expropiado legalmente, salvo cuando en forma voluntaria se sometan al Régimen Forestal.

Tratándose de reservas forestales, zonas protectoras y refugios de vida silvestre y en caso de que el pago o la expropiación no se haya efectuado y mientras se efectúa, las áreas quedarán sometidas a un plan de ordenamiento ambiental que incluye la evaluación de impacto ambiental y posteriormente, al plan de manejo, recuperación y reposición de los recursos.(la negrilla y subrayado es nuestra) // La propiedad objeto de éste proceso forma parte de la ZONA PROTECTORA DE LOS CERROS DE ESCAZÚ, que afecta Alajuelita, Aserrí, Escazú, Santa Ana, Mora, Acosta y Puriscal, por lo que todas las propiedades que están en dicha zona para el criterio de la Sala Primera serían del Patrimonio Natural del Estado y serían INALIENABLES Y DE DOMINIO PÚBLICO lo cual sería una EXPROPIACIÓN DE HECHO, un ACTO DE CONFISCACIÓN y un ENRIQUECIMIENTO ILÍCITO, que atenta contra el artículo 45 de la Constitución Política y el artículo 21 inciso 2 de la Convención Americana de los Derechos Humanos, que sostiene que LA PROPIEDAD ES INVIOLABLE Y A NADIE SE LE PUEDE PRIVAR DE LA SUYA SIN PREVIA INDEMNIZACIÓN CONFORME A LA LEY. // En ningún momento debería incorporarse el SINAC en éste tipo de procesos y ha sido contante para el Tribunal de Apelaciones de lo Contencioso Administrativo, ya que lo que se busca es cumplimiento omisivo de las demandadas conforme el artículo 5 de la Ley Indígena. // Además en una eventual indemnización en el presente proceso, en ningún momento está afectando las limitaciones establecidas por el Sistema Nacional de Áreas de Conservación del Minaet. // Pero ante éste gazapo y aberración jurídica de la Sala Primera y para no quedar en INDEFENSIÓN Y ATRAZAR el proceso, mi representada no tiene más opción que estar de acuerdo y solicitar su incorporación como TERCERO INTERESADO Y NO COMO PARTE DEL PROCESO PARA ASÍ EVITAR UNA EVENTUAL NULIDAD INJUSTIFICADA de parte de la Honorable Sala Primera de Justicia. // Respecto a la INCORPORACIÓN DEL ADI DE QUITIRRISÍ DE MORA en el presente proceso NOS OPONEMOS Y RECHAZAMOS que sea PARTE o TERCERO INTERESADO ya que como se ha expuesto anteriormente en los puntos arriba indicados, los que deben cumplir con la CONDUCTA OMISIVA CONFORME EL ARTÍCULO 5 DE LA LEY INDÍGENA son el INDER y CONAI únicamente. // Además INVERSIONES HIDALGO que es la parte que contrademanda, tiene el derecho y la facultad de determinar a quien dirige su reconvención como paso a explicar: // PRIMERO: Como se puede apreciar EN LAS PRETENSIONES DE LA RECONVENCIÓN DE INVERSIONES HIDALGO que se incluyen dentro del presente Proceso de Conocimiento, NINGUNA VA DIRIGIDA CONTRA LA ASOCIACIÓN INDÍGENA, en ninguna se solicita su intervención o la realización de alguna conducta.

Son el INDER Y LA CONAI, las que mantienen una CONDUCTA OMISIVA CONTINUA desde 1977, de no cumplir con el artículo 5 Ley Indígena, no la Asociación Indígena. // SEGUNDO: Es errónea la interpretación del apelante respecto al artículo 38 CÓDIGO PROCESAL CIVIL, ya que lo que establece es una FACULTAD POR PARTE DEL ACTOR DE RECONVENIR O NO a los partes que considere necesario, y en el caso concreto Nombre164051 elige o determina a quien contrademandar. // ARTÍCULO 38.- Reconvención y réplica 38.1 Reconvención. El demandado podrá reconvenir al actor pero únicamente en el escrito donde conteste la demanda y podrá traer al proceso como reconvenido a quien no sea actor. // La demanda y la reconvención deberán ser conexas o ser consecuencia del resultado de la demanda. La reconvención deberá reunir los mismos requisitos del de la demanda. Si fuera defectuoso, se prevendrá su corrección en los mismos términos de la demanda.

Salvo disposición legal en contrario, la reconvención solo será admisible en procesos ordinarios. (La negrilla y el subrayado es nuestro) // TERCERO: Para poder determinar las PARTES DENTRO DE UN PROCESO, se debe recurrir al ARTÍCULO 220 CPCA y en forma supletoria al ARTÍCULO 22 DEL CÓDIGO PROCESAL CIVIL, el cual nos habla de dos presupuestos: // A. Disposición de Ley // B. O por la naturaleza de la relación Jurídica material. // Respecto a la DISPOSICIÓN DE LEY, ésta no procede en éste caso ya que en ningún momento SE ESTA IMPÚGNANDO LA LEGALIDAD O NO DE UN ACTO ADMINISTRATIVO conforme el ARTÍCULO 12 DE CPCA SINO EL CUMPLIMIENTO DE UNA CONDUCTA OMISIVA. // Respecto a la NATURALEZA JURÍDICA DE LA RELACIÓN MATERIAL y con relación al presente proceso de Conocimiento, el artículo 5 de la Ley Indígena es claro al establecer que al ITCO, hoy INDER, y a la CONAI, se le establecieron una serie de obligaciones, SOLO A ELLOS, que son: // “ con respecto a personas no indígenas que sean propietarias o poseedoras de buena fe dentro de las reservas indígenas, el I.T.C.O., deberá reubicarlas en otras tierras similares si ellas lo desearen; si no fuere posible reubicarlas o ellas o no aceptaren la reubicación, deberá expropiarlas e indemnizarlas conforme a los procedimientos establecidos en la Ley de Expropiación.

Los estudios y trámites de expropiación e indemnización serán efectuados por el I.T.C.O., en coordinación con la CONAI”. El subyado y negrita es nuestro. // El ARTÍCULO 5 DE LA LEY INDÍGENA crea una RELACIÓN JURÍDICA ADMINISTRATIVA que únicamente involucra a las partes demandadas CONAI Y EL INDER. // CUARTO: La SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA ha resuelto también éste tema de la participación de quien tiene que estar presente EN PROCESOS INDEMNIZATORIOS DE TIERRAS DENTRO DE RESERVAS INDÍGENAS, lo anterior mediante el VOTO NÚMERO 001604-F-S1-2012 DE LAS NUEVE HORAS DEL SEIS DE DICIEMBRE DE DOS MIL DOCE: // En su CONSIDERANDO NÚMERO VI: en torno AL LITISCONSORCIO DEL ESTADO señala que el Inder es una INSTITUCIÓN AUTÓNOMA, DE DERECHO PÚBLICO, CON PERSONALIDAD JURÍDICA, PATRIMONIO PROPIO E INDEPENDENCIA ADMINISTRATIVA por lo que no existe necesidad de involucrar a nadie más ya que únicamente es un obligación del INDER en coordinación con CONAI. // En EL CONSIDERANDO VIII la Sala es contundente: EN SU REPARO DE NATURALEZA DIRECTA al señalar: // “para la Sala es diáfano que corresponden al INDER, en lo que resulta de interés para este caso, las siguientes funciones: 1) reubicar a propietarios o poseedores de buena fe fuera de las reservas indígenas y; 2) expropiarlas e indemnizarlas si la reubicación no fuera posible.

La particular forma que se ideó para la dotación financiera del fondo y su administración, no demerita que a la luz de la norma es claro que corresponde al Instituto demandado, en coordinación con el CONAI, realizar los trámites expropiatorios.” (La negrilla es nuestra)// Por todo lo anterior dejo contestado la apelación presentada por el INDER." (Ver expediente digital).

IV. SOBRE LA POSICIÓN DE LA EMPRESA INVERSIONES HIDALGO ÁLVAREZ S. A.

La codemanda civil, señala al respecto de la integración de la litis:

"El suscrito, conocido en autos como el Apoderado Especial Judicial de la empresa INVERSIONES HIDALGO ÁLVAREZ S.A., me presento ante su Autoridad, en tiempo y en forma, a contestar la audiencia concedida en la resolución de las 11.55 horas del 19 de agosto de los corrientes, sobre el Recurso de Apelación interpuesto por el INDER en contra de la resolución No. 1310-2022 de las 15.25 horas del 9 de agosto pasado, dictada en forma oral durante la audiencia preliminar, como sigue: // No comparte esta representación lo alegado por el INDER recurrente, pues parece que no está dimensionando correctamente los extremos de la pretensión de la reconvención, o en otras palabras, está sobredimensionándolos más allá de los efectos que se pretenden en este proceso. Observen señores de este Tribunal, que lo que se pide en la reconvención, es el cumplimiento y ejecución de cuanto dispone el artículo 5º, parte primera, de la Ley Indígena No. 6172, y en concreto, que se realicen los estudios y trámites de expropiación por parte del Inder en coordinación con el CONAI, a efectos de que se establezca el monto indemnizatorio que se pagaría a mi representada.

En razón de lo cual, no es cierto que exista una relación jurídica material, ni funcional, de las pretensiones de la reconvención respecto del ESTADO, y tampoco respecto de la Asociación de Desarrollo Integral Indígena de Quitirrisí.// Es claro que si eventualmente, se acoge la pretensión de la reconvención en este proceso, entonces tendría que iniciarse el proceso de Expropiación, donde probablemente, sí serían parte el Estado -por la parte indemnizatoria que se determine y que deba ser cancelada-, y la Asociación dicha. Pero en este expediente, considerando las pretensiones planteadas en la reconvención interpuesta, no se requiere integrar la litis respecto del Estado, ni tampoco respecto de la Asociación de Desarrollo Integral Indígena de Quitirrisí, porque reitero, no tienen relación jurídica material, ni funcional con las pretensiones planteadas. De ahí que no lleva razón la representante del INDER recurrente, y por tanto, el recurso planteado en esos aspectos, debe ser rechazado. // En cuanto a la Asociación dicha, cabe agregar que el hecho de que eventualmente, ésta sea la que vaya a ser dueña del inmueble del que mi representada, es hoy en día, la propietaria registral y poseedora real y efectiva, no implica que deba reconvenirse a la misma.

Esa circunstancia es simplemente un efecto de la eventual expropiación -en el mejor de los casos- o confiscación -en el peor de los casos-, que sufra mi representada, por encontrarse dicho inmueble dentro del área que se ha definido como Reserva Indígena de Quitirrisí. Y no es cierto, en mi opinión profesional, independientemente de lo que se resolvió en su momento, en la resolución No. 106-2013- I del Tribunal Contencioso Administrativo, expediente No. 07-001117-0163-CA -citada por la recurrente-, que las Asociaciones de Desarrollo Indígena tengan injerencia en los procesos de análisis y determinación de las expropiaciones, como tales, porque estamos hablando de un inmueble que nunca antes ha sido expropiado, y esa obligación, según el mismo artículo 5º de la Ley Indígena, le corresponde a la CONAI. // Por último, sobre los alegatos de la recurrente para sustentar su reclamo de que se integre la litis en contra del Estado, debo señalar que si bien es entendible, por la dimensión económica que esto conlleva, no es éste ni el momento, ni el proceso para hacerlo valer. // Con relación a la necesidad de integrar la litis con el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), pido se rechace también el recurso entablado, toda vez que si bien existe un área de la finca de mi representada que fue afectada por el Decreto Ejecutivo No. 6112 publicado en fecha 17 de julio de 1976 -que delimitó la Zona Protectora El Rodeo-, la cual posteriormente fue ampliada por el Decreto Ejecutivo No. 14672 publicado en fecha 21 de julio de 1983 -que delimitó la Zona Protectora Cerros de Escazú-, es lo cierto que esa declaratoria implica solamente un sometimiento de esa porción de la finca al régimen forestal, sin que por ello, se esté perdiendo el derecho de propiedad privado o de dominio sobre la misma y se traslade a la administración del SINAC.

Es claro que ese sometimiento al régimen forestal implica una limitación a una explotación irracional de los recursos forestales existentes y más bien, una protección a los mismos -zona protegida-, máxime que como se demostró oportunamente, con la prueba documental aportada con la reconvención, pruebas No. 5 a 16, las inscripciones de las fincas registrales que conforman la que hoy es la finca del Partido de San José, matrícula No. Placa33488, se remontan históricamente a fechas muy anteriores a la promulgación de los dos decretos ejecutivos antes relacionados. Por lo que no hay ninguna afectación a los intereses del SINAC. // Para mayor abundamiento, es importante reseñar lo dispuesto por el artículo 3º del Decreto Ejecutivo No. 6112, que reza: “Las fincas debidamente inscritas en el Registro Público o amparadas por la posesión decenal dentro de los límites de las zonas protectoras quedan automáticamente sometidas al régimen forestal.

Las labores que se fueran a realizar en estas fincas, deben contar con la autorización escrita de la Dirección General Forestal.” (El subrayado no es del original). // Y también el artículo 2º del Decreto Ejecutivo No. Placa33489, contiene términos similares, al estipular que: “Los inmuebles -estatales y privados- ubicados dentro de los linderos señalados por el artículo anterior, quedan obligatoriamente sometidos al régimen forestal. En consecuencia, únicamente se podrán realizar en dichas áreas labores que cuenten de previo con la autorización escrita de la Dirección General Forestal.” (El subrayado no es del original). // De ambas normas, claramente se deduce que la declaratoria de un área de la finca de mi representada, como zona protegida, por los Decretos Ejecutivos que establecieron la Zona Protectora El Rodeo y la Zona de Protección de los Cerros de Escazú, no implica una afectación demanial de esa área, sino solamente el sometimiento de la misma al régimen forestal.

Es decir, una limitación al derecho de propiedad que tiene como efecto la racionalización del uso de los recursos forestales allí existentes - nótese que los bienes sujetos a este régimen no pasan a ser de dominio público, manteniéndose en la esfera patrimonial del propietario privado-. Y por tanto, al no existir ninguna relación material entre lo pretendido en la reconvención y una eventual afectación, modificación o declaración de algún modo respecto del régimen forestal dicho, debe declararse sin lugar la excepción opuesta de falta de integración de la litis consorcio pasivo necesaria respecto del SINAC. // En conclusión, solicito se rechace en todos sus extremos, el Recurso de Apelación interpuesto, y se confirme la resolución No. 1310-2022 de las 15.25 horas del 9 de agosto del 2022, dictada por el Tribunal Contencioso Administrativo de este circuito, durante la audiencia preliminar celebrada ese día" (Ver expediente digital).

V: EN CUANTO A LA LITIS CONSORCIO PASIVO: Sobre la eventual existencia de un litis consorcio, resulta oportuno hacer referencia al voto de la Sala Primera número 18 de las 14:30 horas del 27 de abril de 1994, en tanto indicó:

“… IV.- El litisconsorcio es una de las figuras procesales de la pluralidad subjetiva que se caracteriza por situar al tercero (o los terceros) en una relación común con una de las partes, sea con la actora o la demandada, dándose el mismo objeto y la misma causa petendi, de manera que el actor pudo haber dirigido su acción contra el tercero directamente o conjuntamente con el demandado (litisconsorcio pasivo) o que varios sujetos tienen la misma pretensión respecto a otro (litisconsorcio activo) u otros (litisconsorcio mixto). La intervención de los litisconsortes puede darse de dos maneras: facultativa o necesaria. La facultativa corresponde al caso del ejercicio de la acción dirigida en forma conjunta, por quienes tienen las mismas pretensiones nacidas de un mismo título o que se funden en la misma causa, o cuando quien ostenta la pretensión dirige la misma contra todos aquellos que deben responder a ella.

Por su parte el litisconsorcio necesario se da cuando por disposición de la ley o por la naturaleza de la relación jurídica, se exige que los sujetos a quienes afecta la resolución, actúen conjuntamente, como litisconsortes, de manera que queden vinculados al proceso y consecuentemente a los efectos de la sentencia. V.- El litisconsorcio necesario supone que para resolver el asunto han de estar presentes en el proceso todos aquellos sujetos a los que tal resolución fuere a afectar, de ahí entonces la facultad que se le confiere al Juez de declarar de oficio la existencia del litis consorcio necesario, no siendo entonces una simple defensa previa (artículo 298 Código Procesal Civil vigente), de uso únicamente por parte del demandado. El juez puede integrar el litis consorcio necesario .., y conforme al ... mismo cuerpo normativo le corresponde al juez tomar como medida de saneamiento, desde la admisión de la demanda y en las oportunidades que corresponda, integrar la litis consorcio necesario.

El litis consorcio necesario implica la existencia de relaciones jurídicas materiales respecto de las cuales no es posible pronunciarse fraccionándolas o calificándolas sólo en relación de algunos de sus sujetos, pues la decisión engloba y obliga a todos. La presencia de todos los sujetos es indispensable para que la relación procesal se complete y sea posible decidir en sentencia sobre el fondo de la misma (Sala Primera de la Corte número 72 de 15 horas del 3 setiembre 1982). El Código de Procedimientos Civiles derogado no contenía norma expresa sobre el litisconsorcio pasivo necesario, sin embargo, por interpretación del artículo 1º párrafo in fine de ese cuerpo normativo tradicionalmente se consideró que el mismo regulaba de manera indirecta la legitimatio ad causam activa y pasiva y su modalidad de litisconsorcio necesario.” El artículo 66 inciso 1), del Código Procesal Contencioso Administrativo, establece como una causa de inadmisibilidad de la demanda, en relación con los ordinales 58 y 61 ibídem, que los escritos de interposición de la acción tengan defectos formales que impidan verter pronunciamiento en cuanto al fondo del asunto; entre cuyos defectos la jurisprudencia ha señalado la litis consorcio pasivo necesaria.

Dicha situación se presenta cuando, para dictar sentencia, la misma debe referirse en contra de alguna persona que no se ha apersonado en autos por falta de instancia de la parte actora; o bien sea, cuando el pronunciamiento debe afectar los derechos o intereses de alguien que no ha sido traído al proceso para que se entere del mismo, y en su oportunidad, defienda su posición. Al efecto la doctrina ha considerado tal situación, en condiciones idénticas a la jurisprudencia, al identificarlo como "la pluralidad de partes principales, unidas en su actuación procesal, bien demandantes (litisconsorcio activo), demandadas (litisconsorcio pasivo) o demandantes y demandadas (litisconsorcio mixto)" [Nombre31309 (Nombre304), Comentarios a la Ley de Jurisdicción Contencioso Administrativa, Madrid, Editorial Civitas, 1ra.Edic., 1978, pag.463]. Así, el litis consorcio pasivo necesario hace referencia a la imperiosa necesidad de que en un proceso figuren como demandados todos aquellos sujetos a quienes eventualmente podrían afectarles la decisión judicial que por el fondo se adopte. Este instituto se encuentra regulado en el artículo 22 del Código Procesal Civil vigente, al señalar:

"ARTÍCULO 22.- Pluralidad de partes y personas 22.1. Litisconsorcio necesario. Cuando por disposición de la ley o por la naturaleza de la relación jurídica material, la decisión deba hacerse con varias personas, estas deberán demandar o ser demandadas en el mismo proceso.// Los tribunales ordenarán a la parte que dentro de cinco días amplíe su demanda o contrademanda contra quienes falten, bajo el apercibimiento de dar por terminado el proceso en cuanto a la demanda o contrademanda, según corresponda. // El demandante, al integrar la litis, solo podrá añadir a las alegaciones de la demanda inicial aquellas otras imprescindibles para justificar las pretensiones contra los nuevos demandados, sin alterar sustancialmente lo pedido. " En cuanto a la relación jurídica material poco dice el Código Procesal Contencioso Administrativo, pero en cuanto a la integración por imperio de ley señala el canon doce de ese cuerpo normativo:

"ARTÍCULO 12.- Se considerará parte demandada:

  • 1)La Administración Pública autora de la conducta administrativa objeto del proceso, salvo cuando se trate de los Poderes Ejecutivo, Legislativo, Judicial y del Tribunal Supremo de Elecciones; en este caso, se demandará al Estado.
  • 2)Los órganos administrativos con personalidad jurídica instrumental, en tanto sean autores de la conducta administrativa objeto del proceso, conjuntamente con el Estado o el ente al que se encuentren adscritos.
  • 3)Las personas físicas o jurídicas que hayan derivado derechos e intereses legítimos de la conducta administrativa objeto del proceso.
  • 4)Cualquier otra persona que haya sido llamada al proceso como responsable, en su carácter funcional o personal.
  • 5)La Contraloría General de la República:
  • a)Conjuntamente con el Estado, cuando el proceso tenga por objeto la conducta administrativa de aquella, relacionada con el ejercicio de su competencia constitucional y legal.
  • b)Conjuntamente con el ente fiscalizado, cuando el proceso tenga por objeto una conducta administrativa sometida a su control, en el ejercicio de sus potestades de fiscalización o tutela superior de la Hacienda Pública.
  • 6)Cuando una entidad dicte algún acto o disposición que, para su firmeza, requiera previo control, autorización, aprobación o conocimiento, por parte de un órgano del Estado o de otra entidad administrativa, se tendrá como parte demandada:
  • a)El Estado o la entidad que dictó el acto o la disposición fiscalizados, si el resultado de la fiscalización ha sido aprobatorio.
  • b)La entidad que ha ejercido la fiscalización, si esta no ha aprobado el acto o la disposición.
  • 7)Cuando una entidad dicte algún acto o disposición, que en virtud de un recurso administrativo no jerárquico -facultativo u obligatorio- deba ser conocido por parte de un órgano del Estado o de otra entidad administrativa, se tendrá como parte demandada:
  • a)El Estado o la entidad que dictó el acto, cuando este ha sido confirmado.
  • b)La entidad que, conociendo el recurso, anula, revoca o reforma la conducta cuestionada.
  • 8)Si el demandante funda sus pretensiones en la ilegalidad de una disposición general, se considerará también parte demandada a la Administración autora de esta, aunque la actuación recurrida no procede de ella." Ahora bien, como ya se ha adelantado, según el caso, puede tratarse de una situación simple o facultativa, cuando se produce por voluntad de las partes, o necesaria cuando es efecto de la imposición de la ley. Sobre el tema, la Sala Primera de la Corte Suprema de Justicia ha mantenido:

"I.- Todos los procesos, según los antecedentes que les asistan, pueden dar lugar a que en ellos intervengan pluralidad de sujetos -relación procesal plural o múltiple-, lo cual se puede manifestar en dos sentidos: como pluralidad por coordinación, sea cuando las partes se encuentran en un mismo plano o como pluralidad por subordinación cuando no lo están. Corresponde al primer sentido dos figuras importantes dentro de la dinámica procesal: el litisconsorcio y la intervención de terceros; y en cuanto a la pluralidad por subordinación se debe incluir en ella la participación coadyuvante. Pueden señalarse diversos tipos o clases de intervención de terceros, como lo son: a) Intervención voluntaria: cuando su participación en el proceso responde únicamente a su voluntad ostentando dentro del proceso un interés contrario al de una o ambas partes (entiéndase actor o demandado); b) Intervención adhesiva: cuando el sujeto acude al proceso o es llamado a él para intervenir en favor de una de las partes, y c) Intervención obligada: se trata de aquellos terceros cuyo derecho se puede calificar como paralelo al del actor o al del demandado.

II.- El litisconsorcio es una de las figuras procesales de la pluralidad subjetiva que se caracteriza por situar al tercero (o los terceros) en una relación común con una de las partes, sea con la actora o la demandada, dándose el mismo objeto y la misma causa petendi, de manera que el actor pudo haber dirigido su acción contra el tercero directamente o conjuntamente con el demandado (litisconsorcio pasivo) o que varios sujetos tienen la misma pretensión respecto a otro (litisconsorcio activo) u otros (litisconsorcio mixto). La intervención de los litisconsortes puede darse de dos maneras: facultativa o necesaria. La facultativa corresponde al caso del ejercicio de la acción dirigida en forma conjunta, por quienes tienen las mismas pretensiones nacidas de un mismo título o que se funden en la misma causa, o cuando quien ostenta la pretensión dirige la misma contra todos aquellos que deben responder a ella.

Por su parte la litisconsorcio necesario se da cuando por disposición de la ley o por la naturaleza de la relación jurídica, se exige que los sujetos a quienes afecta la resolución, actúen conjuntamente, como litisconsortes, de manera que queden vinculados al proceso y consecuentemente a los efectos de la sentencia." (Sala Primera de la Corte Suprema de Justicia, Nº 72 de las 15:00 horas del 13 de setiembre de 1982).- La cual, según la situación en concreta, puede tratarse de una situación simple o facultativa, cuando se produce por voluntad de las partes, o necesaria cuando se produce por imposición de la ley. Sobre el tema, la Sala Primera de la Corte Suprema de Justicia ha mantenido:

"I.- Todos los procesos, según los antecedentes que les asistan, pueden dar lugar a que en ellos intervengan pluralidad de sujetos -relación procesal plural o múltiple-, lo cual se puede manifestar en dos sentidos: como pluralidad por coordinación, sea cuando las partes se encuentran en un mismo plano o como pluralidad por subordinación cuando no lo están. Corresponde al primer sentido dos figuras importantes dentro de la dinámica procesal: el litisconsorcio y la intervención de terceros; y en cuanto a la pluralidad por subordinación se debe incluir en ella la participación coadyuvante. Pueden señalarse diversos tipos o clases de intervención de terceros, como lo son: a) Intervención voluntaria: cuando su participación en el proceso responde únicamente a su voluntad ostentando dentro del proceso un interés contrario al de una o ambas partes (entiéndase actor o demandado); b) Intervención adhesiva: cuando el sujeto acude al proceso o es llamado a él para intervenir en favor de una de las partes, y c) Intervención obligada: se trata de aquellos terceros cuyo derecho se puede calificar como paralelo al del actor o al del demandado.

II.- El litisconsorcio es una de las figuras procesales de la pluralidad subjetiva que se caracteriza por situar al tercero (o los terceros) en una relación común con una de las partes, sea con la actora o la demandada, dándose el mismo objeto y la misma causa petendi, de manera que el actor pudo haber dirigido su acción contra el tercero directamente o conjuntamente con el demandado (litisconsorcio pasivo) o que varios sujetos tienen la misma pretensión respecto a otro (litisconsorcio activo) u otros (litisconsorcio mixto). La intervención de los litisconsortes puede darse de dos maneras: facultativa o necesaria. La facultativa corresponde al caso del ejercicio de la acción dirigida en forma conjunta, por quienes tienen las mismas pretensiones nacidas de un mismo título o que se funden en la misma causa, o cuando quien ostenta la pretensión dirige la misma contra todos aquellos que deben responder a ella.

Por su parte la litisconsorcio necesario se da cuando por disposición de la ley o por la naturaleza de la relación jurídica, se exige que los sujetos a quienes afecta la resolución, actúen conjuntamente, como litisconsortes, de manera que queden vinculados al proceso y consecuentemente a los efectos de la sentencia." (Sala Primera de la Corte Suprema de Justicia, Nº 72 de las 15:00 horas del 13 de setiembre de 1982).- No esta demás indicar que en tratándose de procesos civiles de hacienda, de forma reiterada la jurisprudencia ha señalado que no resulta posible la integración de la litis, salvo por imperio de ley, en tanto el derecho de accionar, es un derecho y como tal la parte escoge hacia que persona física o jurídica dirige su acción; asumiendo para si las consecuencias de tal decisión. Obligar a traer a una persona diferente es vulnerar el derecho de escogencia que le corresponde a la parte frente a quien ejerce su derecho.

VI: EN CUANTO AL FONDO: El tema traído a discusión por el Instituto de Desarrollo Rural ha sido motivo de discusión en múltiples ocasiones por este Tribunal, en ambas Cámaras y en diferentes integraciones; y si bien, al inicio generó algunas resoluciones contradictorias, en los últimos años, presenta una resolución idéntica, aún cuando siempre subsiste un voto disidente. Como primer aspecto considera la parte que si bien bien el proceso técnicamente no es un proceso civil de hacienda, al amparo de los artículos doce inciso tres y cuatro, con relación al veintidós del Código Procesal Civil (aunque se cita el ciento seis del mismo cuerpo normativo que fue derogado hace cuatro años) debe integrarse la litis. Con respecto a los procesos civiles de hacienda, ha sido la postura reiterada de esta Cámara el señalar que la parte quien demanda es quien define contra quien endereza su acción y asume las consecuencias positivas o negativas de tal decisión no siendo aplicables ninguna de las normas antes indicadas, salvo la integración por imperio de ley.

En ese plano no es posible considerar una integración de litis como lo pretende la accionada, aspecto que se le ha indicado ya en ocasiones anteriores, motivo por el cual no vemos necesario volver a ahondar sobre el tema, cuando el mismo ente reconoce la existencia de esa posición, solamente que no la comparte, y como una postura -conveniente a sus intereses- considera que no debe aplicarse. En ese sentido, se ha hecho ver que son dos aspectos muy diferentes el tema del origen de los fondos, con respecto a la integración de la litis. El proceso será declarado con lugar, si a juicio del Tribunal de sentencia el mérito de los autos así lo amerita, si el dinero para cancelar cualquier indemnización debe provenir de las rentas propias del INDER, o si debe realizar las coordinaciones de estilo con el Estado central, y con ello procurar que se incluya una partida en el presupuesto nacional, es un tema que ni a la actora, ni a la reconventora le resulta de interés o relevancia, sino que es tópico propio de la coordinación administrativa.

El único interesado en hacer más sencillo el trámite es el INDER, quien no quiere verse en dicho trámite. En consecuencia, dicho agravio no lleva razón de ser y debe ser rechazado. Los argumentos vertidos en el agravio, de que la demanda o la reconvención, debió ser dirigida hacia el Estado y no hacia los accionados, por diferentes motivos que expone el ente recurrente. Si bien, ambos aspectos pese a lo interesantes que son, su conocimiento corresponde al Tribunal sentenciador, sea por una falta de legitimación activa, pasiva o carencia de derecho; pues como se indicó son otros los factores que determinan una integración de litis, motivo por el cual deben ser rechazados. Dejado eso de lado, alega el recurrente durante la expresión de agravios, en síntesis, que el Estado debe intervenir en el proceso, porque es quien en definitiva suministrará los fondos con los que se satisfará lo pretendido, debiendo además velar que no se desnaturalicen, pagando tierras que no deberían ser indemnizadas con esos dineros y comprobando que la persona beneficiada con la sentencia tenga verdaderamente el derecho a lo que solicita.

Respecto a la posición del ente recurrente, este Tribunal, discrepa de los planteamientos esbozados, tomando en consideración que la pretensión y la teoría del caso del actor implica una obligación de hacer (nacida en un reclamo por omisión de conducta debida), aunado a un tema civil de hacienda, que se traduce en una indemnización (daños y perjuicios), esta última es la base de la reconvención. El enfoque del accionante, en un contexto típico de responsabilidad, es que el INDER es el obligado a la conducta administrativa y, además, a su aspecto pecuniario, según la Ley Indígena. Precisamente subyace la discusión -que deberá ser resuelta en sentencia- acerca de un pago insatisfecho, el cual se origina en una obligación de hacer, señalada como incumplida. En ese contexto la parte actora y la reconventora consideró exigir lo debido -en forma exclusiva- a quien ya aparece como sujetos pasivos.

La discusión de cuál es la proveniencia de los fondos con los cuales deberá cancelarse los extremos peticionados por el actor, son aspectos propios de la coordinación administrativa como ya se adelantó; la parte recurrente pretende traer al Estado con el único fin de evitar esa actividad, lo que jurídicamente no tiene sentido. Esta tesis además la ha delimitado la Sala Primera, para casos como el actual, indicando: "VI.- (...) La Ley no. 2825 del 8 de diciembre de 1962 creó el Instituto de Tierras y Colonización. Mediante la Ley no.6735 del 29 de marzo de 1982, ese Instituto se transformó en el Instituto de Desarrollo Agrario, que en su artículo 1 se definió como una “institución autónoma de derecho público, con personalidad jurídica, patrimonio propio e independencia administrativa.”. Esta última, a su vez, sufrió una reciente reforma, pues la Ley no. 9036 del 29 de mayo de 2012, transformó el IDA en el Instituto de Desarrollo Rural (INDER), pero su artículo 14, mantuvo literalmente la norma transcrita anteriormente, esto es, constituye una institución autónoma, de derecho público, con personalidad jurídica, patrimonio propio e independencia administrativa.

Como institución autónoma que es, dado que conforme al artículo 5 supra citado, le corresponde la expropiación de los terrenos ubicados en reservas indígenas, bajo la posesión o propiedad de personas no indígenas, es claro que no existe necesidad de involucrar en el litigio al Estado, pues el ejercicio de la competencia cuya omisión reclamó el actor (que no ha sido expropiado), corresponde al INDER en coordinación con el CONAI, no así al Estado. El que la incorporación de los territorios a la reserva fuera dispuesto por vía decreto, no merma lo dicho hasta acá, pues corresponde al INDER, en coordinación con el CONAI, asumir las competencias dotadas por ley para la tutela de tales terrenos orientados a la protección de la población indígena. Así las cosas, no se constata el defecto en la integración de la litis que refiere respecto del Estado" (SALA PRIMERA. Voto N° 001604-F-S1-2012 DE 9:00 horas de 6 de diciembre de 2012).

El INDER invoca a su favor una serie de resoluciones del Tribunal Contencioso Administrativo y de la Sala Primera en su favor, sobre las primeras, es de precisar que respetamos dichas posturas pero no las compartimos, mientras que en lo atinente a la Sala Primera de la Corte Suprema de Justicia, uno de los expedientes no corresponde al supuesto que ahora se conoce, y los remanentes, son posiciones que hace ya varios años fueron abandonadas. De manera que los antecedentes jurisprudenciales no son de recibo, debiendo ser rechazado. Con respecto a la integración de la asociación de desarrollo Integral de la Reserva Indígena de Quitirrisí de Mora, se requiere su integración en tanto podría generarse una cantidad de aumento del terreno que debe administrar. Al respecto el Tribunal puede comprender que en cuanto la decisión puede afectar a más agrupaciones indígenas, es de recordar la naturaleza de los terrenos aborígenes, los que en principio son bienes demaniales y consecuentemente, las diferentes entes públicos (o incluso privados como es el caso de las asociaciones de pueblos autóctonos) no son más que administradores de dichos bienes.

En el expediente esta representado el por la CONAI, quien esta llamados a ejercer todas las acciones en beneficio de todas las agrupaciones aborígenes, sin perjuicio de las acciones que estas pueden ejercer por su propia cuenta. En dichos términos el agravio carece de todo sustento. Por último en lo que corresponde al Sistema Nacional de Áreas de Conservación, para nadie es un secreto que la mayoría de los territorios autóctonos presentan una doble afectación, por un lado la ambiental, en tanto dichos grupos humanos presentan una convivencia más armónica, lo que determina la proliferación de la flora y la fauna propia de la zona, aspecto en el cual cumplen un papel preponderante en el equilibrio con el medio ambiente. Por el otro, tienen una forma de vida que lleva incluido una cultura milenaria, que merece respeto. En ese sentido de prosperar la gestión de la acción actora, nada impide que el Estado, eventualmente realice una valoración desde dos ángulos sobre un bien afecto al demanio público.

Eso no impide a que si el SINAC ha realizado estudios y llegado a la conclusión que debe realizar una afectación diversa, bien puede instaurar la acción que tenga a bien mediante el respectivo proceso, sin que sea necesario integrarlo al actual. Retomando la base para la integración de la litis, como se indicó en el considerando precedente esta solo tiene sustento por dos motivos, el primero de ellos por la relación jurídico material, la que se extrae de la relación de hechos y por la pretensión, siendo que ni uno ni otro esta orientada hacia al Estado, el Sistema Nacional de Áreas de Conservación o hacia la Asociación que se pretende incluir como accionada ni en la acción ni en reconvención. No dando base para variar lo resuelto. El otro motivo, es cuando por imperio de ley se deba integrar, pero ni el Estado, al Sistema Nacional de Áreas de Conservación o la Asociación presentan norma alguna que sustente tal afirmación.

Es evidente que la Asociación tiene un interés en la devolución de los terrenos en discusión, pero sobre la existencia de la expropiación y un eventual pago por este concepto son aspectos cuya relevancia es indirecta o inexistente. Lo pretendido para la representación del ente representativo de los aborígenes ya esta cumplido por imperio de ley, de suerte que no requiere apersonarse al proceso. Los restantes argumentos, como ya se adelantó no permiten variar lo resuelto, en tanto los motivos para la integración pasiva necesaria no son los mismos que permiten orientar la demanda en favor de una u otra parte, motivo por el cual deben ser rechazados. En virtud de lo anterior, se confirma la decisión apelada.

VII: VOTO SALVADO DEL JUEZ GONZÁLEZ VÍLCHEZ: Con el respecto a mis compañeros, salvo el voto, únicamente, en que considero que el Estado debe ser parte demandada en este asunto. Lo anterior se sustenta en el artículo 5 de la Ley Indígena, N°6172, en el cual se establece que el pago de las eventuales indemnizaciones que deban tramitarse por esa ley, se hará por medio de presupuestos generales de la República, y esto provoca, en mi criterio, que el Estado debe estar presente en este tipo de procesos, en caso de que, eventualmente, la demanda pueda ser declarada con lugar. En consecuencia, admito parcialmente el recurso de apelación, y ordeno integrar al Estado.

POR TANTO:

En lo que es objeto de recurso, se declara sin lugar el recurso de apelación instaurado, confirmándose el auto venido en alzada. El Juez González Vilchez, salvo su voto únicamente en cuanto a la integración del Estado. Notifíquese. Otto González Vilchez, Alner Palacios García y Ricardo Madrigal Jiménez.
