Proceeding declared to involve purely questions of law (puro derecho), brought by EMPRESA PROPIETARIA DE LA RED S.A. (hereinafter EPR), corporate identification number CED108665, represented by its general attorney-in-fact with full powers and without limitation as to amount (apoderado generalísimo sin límite de suma), Nombre113345, married, engineer, identity card number CED108666, and resident of Escazú, against Nombre137177, married once, identity card number CED108667, and resident of Esparza. BACKGROUND (RESULTANDO)
WHEREAS (CONSIDERANDO)
I.Proven facts (hechos probados). For purposes of these proceedings, the following relevant facts are deemed established:
II.Unproven facts (hechos no probados). Because the record contains no supporting evidence, the following are deemed unproven: 1) The instrument that supported registration of the property described in proven fact one with the Registro Nacional under Puntarenas property registration number Placa25590. 2) The instrument that supported registration of properties Placa25591, Placa25592, and Placa25593 (now closed), all in Puntarenas. 3) The plans that supported registration of the properties recorded with the Registro Nacional under property registration numbers Placa25590, Placa25591, Placa25592, and Placa25593 (the latter three now closed), all in Puntarenas, and whether those plans recorded the existence of the electrical-line easement to which Mr. Nombre137178 consented in favor of SIEPAC. 4) The instrument that supported registration of the property in Puntarenas bearing real-property folio number Placa25594 in the name of Nombre137181. 5) Whether Mr. Nombre137178 informed Ms. Nombre137181 or Mr. Nombre137177 of the existence of the easement to which he had consented and which is referred to in proven fact one.
III.Subject matter of the proceedings (objeto del proceso). The plaintiff company asserts principal and alternative claims (pretensiones principales y subsidiarias). In essence, the first seeks a declaration that the defendant herein is obligated to execute, in its favor, the deed establishing the easement encumbrance for the passage of the electrical power transmission line across the property he owns, registered with the Registro Nacional, Puntarenas, under real-property folio number Placa25594, on the same terms stipulated by Mr. Nombre137178 in the year 2005. In the alternative, it makes three requests. The first seeks an order that, should the defendant refuse to execute it, the deed be executed by a judicial authority during the judgment-enforcement stage (etapa de ejecución de sentencia). It also seeks a declaration that it acquired by acquisitive prescription (prescripción positiva), in accordance with Articles 378 and 868 of the Código Civil, the easement right for the passage of an electrical power transmission line across the defendant’s property, registered with the Registro Nacional, Puntarenas, under real-property folio number Placa25594, and that the certified judgment (ejecutoria) be transmitted to the Registro Público for registration of the easement right on the same terms under which Mr.
Nombre137178 imposed the easement in the year 2005. Finally, it requests a declaration that the defendant is obligated to comply with the terms and conditions under which establishment of the easement right was agreed in the year 2005. Defendant Nombre137177 opposed the complaint but raised no defenses (excepciones). For the sake of orderly analysis, the legality of the relief sought will be examined according to the thematic issues raised in the arguments of the plaintiff and the defendant, to avoid unnecessary repetition, while, of course, duly analyzing every argument presented.
IV.On the specific case. For a better understanding of what will be decided, we consider it essential to refer briefly to the nature of the petitioner company and the legal regime to which it is subject. In this regard, and by way of background, we must refer to the “Framework Treaty for the Central American Electricity Market and its Protocol” (“Tratado Marco del Mercado Eléctrico de América Central y su Protocolo”), signed by the governments of Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua and Panamá and approved in our country by Ley Nº 7848 del 20 de noviembre de 1998. The purpose of that treaty is the formation and gradual growth of a competitive Regional Electricity Market (Mercado Eléctrico Regional), based on reciprocal and nondiscriminatory treatment, that contributes to the sustainable development of the region within a framework of respect for and protection of the environment (artículo 1).
The second provision establishes the purposes of that regional instrument, among which it is important to highlight the objectives of establishing the conditions for the growth of the Regional Electricity Market so that the electricity required for economic and social development is supplied in a timely and sustainable manner; promoting the interconnection infrastructure necessary for the development of the Regional Electricity Market; creating the conditions necessary to foster acceptable levels of quality, reliability and security in the supply of electricity throughout the region; and ensuring that the benefits derived from the Regional Electricity Market reach all inhabitants of the countries in the region. As relevant here, ordinal 15 provides that “(...) Each Government shall designate a public entity in its country to participate in a publicly owned or partly privately owned company for the purpose of developing, designing, financing, constructing and maintaining an initial regional transmission system that will interconnect the electricity systems of the six countries.
Its articles of incorporation shall ensure that no shareholder may own a percentage of shares giving it majority control of the company. This company, known as Empresa Propietaria de la Red (EPR), shall be governed by private law and legally domiciled in a Central American country. (...)” (emphasis not in the original). In the case of Costa Rica, we must indicate that, pursuant to artículo 3 de la Ley N° 9004 del 31 de octubre del 2011, which “Approves the Second Protocol to the Framework Treaty for the Central American Electricity Market” (“Aprueba el Segundo Protocolo al Tratado Marco del Mercado Eléctrico de América Central”), it was established that Costa Rica’s only agents in the Regional Electricity Market are the Instituto Costarricense de Electricidad (ICE) and its companies, in accordance with inciso b) del artículo 6 de la Ley N.º 8660, Fortalecimiento y Modernización de las Entidades Públicas del Sector Telecomunicaciones, de 8 de agosto de 2008.
The foregoing is supported by the petitioner company’s own representations, in which it explains that the shareholders representing our country in the EPR are ICE and the Compañía Nacional de Fuerza y Luz. Bearing the foregoing in mind, we must again refer to the Framework Treaty, artículo 31 of which states that “(...) The public entities of the member countries engaged in any activity involving the generation, transmission, distribution and sale of electricity are authorized to: (...) b) Subscribe for shares in the commercial company that constructs the first regional interconnection line. For this purpose, they may make cash and nonmonetary contributions, such as land, easement rights (derechos de servidumbre), designs, surveying and others. (...)”. At this point, it is also essential to bear in mind that, pursuant to artículo 5 de la Ley No. 7593 del 9 de agosto de 1996, the supply of electricity at the generation, transmission, distribution and sale stages constitutes a public service (servicio público) in our country.
This is important because, although the EPR is governed by private law pursuant to ordinal 15 of the aforementioned Treaty, this Court cannot overlook that, because it is responsible for executing the interconnection project for the regional generation and transmission of electricity among the Central American countries (artículos 7 al 17 del mismo Tratado), it undeniably administers and provides a public service. This has been recognized by the Sala Primera de la Corte Suprema de Justicia, for example, in resolución No. 1534-C-S1-2013 dictada a las 11 horas 50 minutos del 7 de noviembre del 2013, which held that even civil claims brought by the EPR fall within this Jurisdicción Contencioso Administrativa y Civil de Hacienda rather than the Jurisdicción Civil, basing that decision on the fact that “(...) although it is indeed a private company, it is owned by the six public electricity companies of Central America, as authorized by the Framework Treaty for the Central American Electricity Market, ratified by Costa Rica through Ley no. 7848 de 1998; moreover, that company administers a public service and owns an electricity transmission line extending across the Central American isthmus.
As a result of the foregoing, there is an evident state interest in this matter (...)” (emphasis not in the original). Furthermore, as stated supra, its shareholders are precisely two public institutions: ICE and CNFL. It is therefore a public enterprise (empresa pública) organized as a private-law entity—a corporation (sociedad anónima). Based on the foregoing, the Court is convinced that, in exercising powers relating to the public service it provides, the EPR must act subject and subordinate to the principle of legality (principio de legalidad), which governs the conduct of Public Administrations and constitutes an essential pillar of every Social and Democratic State governed by the rule of law (Estado Social y Democrático de Derecho), as supported by numeral 11 de la Constitución Política y de la Ley General de la Administración Pública (en adelante LGAP). This means that its actions in administering and providing the public service are subject to the entire body of administrative law (ordenamiento jurídico administrativo).
In the case before us, and as we will analyze infra, the subjection of the EPR’s conduct to the body of legality (bloque de legalidad) and to the procedures and formalities regulated therein takes on particular importance because of its impact on the guarantee of the inviolability of private property, established as a general rule by artículo 45 de la Constitución Política. By way of exception, the constitutional provision also establishes, on the one hand, the obligation of the State, broadly understood, to compensate the owner in advance when it must extinguish the owner’s property right for reasons of “legally established public interest” (“interés público legalmente comprobado”), for which purpose it must exercise the power of expropriation (potestad expropiatoria) in accordance with the procedure established by the legal system. On the other hand, párrafo segundo del ordinal 45 constitucional regulates the possibility of establishing restrictions on property in the social interest (limitaciones de interés social a la propiedad) through a law adopted by a qualified vote.
From the foregoing, the Court clearly understands that, in exercising powers related to the public service entrusted to it, the EPR may need, among other activities, to impose transmission-line rights-of-way (servidumbres de paso de línea eléctrica de transmisión) allowing it to place the structures (lines, poles, towers, equipment and appurtenances) and conductors of a transmission line, and subsequently maintain them, on land belonging to other owners. However, we consider that these easements (servidumbres) must be imposed in absolute compliance with the body of legality, particularly because, we reiterate, they constitute an encumbrance (gravamen) on the ownership of real property for the benefit or use of a third party or another estate and, in this case, for the benefit of the community as a whole, because they involve installations necessary for the proper operation of electricity transmission and distribution lines.
Based on the foregoing, we consider that two possible scenarios may arise. The first is that the EPR, following negotiations with the holders of rights in the property to be encumbered, establishes the easement in question and provides financial compensation to the owners of the servient estate (fundo sirviente). This is because the easement imposes upon the owner of the property over which it is established the obligation to bear a burden that includes obligations to refrain from acting and to tolerate certain acts, all for the benefit of a third party or another estate and, as stated previously, in this case for the benefit of the community as a whole; the beneficiary thereby acquires the ability to make use of and utilize the property for the purposes specified when the easement was established. To that extent, its impact on the right of ownership is undeniable, as may be inferred from artículos 370 a 378 del Código Civil (en adelante CC).
The EPR must also subsequently register the easement with the Registro Nacional in order to provide public notice through the registry (publicidad registral) and make it effective against third parties, as follows from numerales 455, 459 inciso 2) y 461 del CC. A second scenario would arise if the EPR failed to obtain the owners’ consent to establish the easement and a public interest existed in doing so. In that situation, it is clear that implementation of the SIEPAC project would require the contribution of real property, which would in turn entail expropriating the owners of the affected estates. In that case, pursuant to artículo 31 del Tratado, ICE would be required to initiate the corresponding proceedings and procedures, in accordance with, among other provisions, numerales 1 y 22 de la Ley No. 6313 del 4 de enero de 1979 (Ley de Adquisiciones, Expropiaciones y Servidumbres del ICE).
It follows clearly from both provisions that, in order to establish compulsory easements (servidumbres forzosas) for the installation of electricity and telecommunications lines when the owner of the affected estate objects, the expropriation procedure established by that legislation must necessarily be followed. Obviously, if the owner of the estate consents, such a procedure is unnecessary. However, pursuant to el artículo 23 de la Ley No. Placa6506 citada in relation to cánones 455, 459 inciso 2) y 461 del CC, even in that situation, the easement must be noted in the property registration of the servient estate in order to be effective against third parties. Based on the foregoing, we now proceed to examine the disputed issues.
V.The principal claim asserted by the plaintiff company is, in essence, for a declaration “(...) that the defendant herein is required to execute the deed establishing the easement encumbrance (gravamen de servidumbre) for the passage of the electric power transmission line in favor of my client over the property owned by him, registration Placa25589, under the same terms as those stipulated by Nombre137178 in the year 2005; (...).” However, in the Court’s view, this request cannot be granted for the following reasons. Pursuant to proven facts 1 and 3 of this judgment, there is no dispute in these proceedings concerning the establishment of a permanent easement (servidumbre permanente) in favor of EPR for the passage of the transmission line owned by EPR (the SIEPAC project), through which the electricity acquired from private generators or from the various plants it installs within and outside the country would be conveyed, as well as for passage on foot or by vehicle, over the property now owned by the defendant herein.
That easement was established through a private contract of no certain date, executed on 19 de marzo del 2005 between EPR and Nombre137178, who at that time possessed the property, which was not registered in the Registro Nacional. It has also been established that, when the easement agreement was executed, EPR compensated Nombre137178 for the portion of his land that the easement would occupy and that, subsequently, on 3 de noviembre del 2007, he was also compensated for the installation of a tower site to support and elevate the electrical cables of the electric transmission line (proven facts 1 and 3). Finally, under that agreement, Nombre137178 undertook to comply with the agreement and, if he sold the parcel or any portion thereof, to notify the purchaser of the easement he was establishing (proven fact 1). Nevertheless, it has also been established that Nombre137178 subsequently registered the property upon which he had consented to the imposition of the easement in the Registro Nacional under Partido de Puntarenas registration Placa25590, without recording its existence, with the result that the property was registered without any annotations and solely with encumbrances (gravámenes) relating to reservations under the Ley de Caminos and the Ley de Aguas (proven fact 4).
Nor did he record the existence of that easement when the properties registered under real-property folio numbers Placa25591, Placa25592 and Placa25593 were created from that property (proven fact 5), or upon their subsequent consolidation, which was documented in the survey plan registered in the Catastro Nacional under number 6-1792842-2015; that plan likewise did not record the existence of any easement and referred only to the existence of a tower (proven fact 6). Consequently, the property resulting from the consolidation of those three properties, now identified by real-property folio registration Placa25594, was subsequently registered in the name of Nombre137181 on 24 de abril del 2015, without annotations and, once again, without any easement, since the only encumbrances recorded concerned the reservations under the Ley de Caminos and the Ley de Aguas, a mortgage, and an attachment that had been entered (proven fact 7).
Finally, on 31 de enero del 2018, Nombre137181 sold to the defendant Nombre137177 the property registered in the Registro Nacional, Partido de Puntarenas, under real-property folio registration Placa25594, subject to the reservation encumbrances under the Ley de Caminos and the Ley de Aguas, the mortgage, and the annotation of the attachment indicated by the Registry, but free of any other type of annotation (proven fact 8). In other words, neither the deed nor the Registro Nacional recorded the existence of any easement affecting that property. In short, as of 18 de noviembre del 2019, the registered owner of the property entered in the Registro Nacional, Partido de Puntarenas, under real-property folio registration Placa25594 was the defendant Nombre137177, and according to the registry information, that property had no annotations and the only recorded encumbrances concerned the aforementioned reservations under the Ley de Caminos and the Ley de Aguas (proven fact 9).
From this factual account, the Court reaches several conclusions that provide the basis for its decision to deny the relief sought by the plaintiff company. The first is that, although EPR established the aforementioned easement through a private contract and compensated the then-owner for bearing that encumbrance, Nombre137178 did not register it when he first registered the property in the Registro Nacional, or during the subsequent registry transactions and transfers. In addition to Nombre137178’s omission, EPR likewise failed throughout all these years to exercise due diligence or seek registration of the encumbrance so as to provide notice to third parties (publicidad ante terceros), as required by Articles 455, 459 subsection 2), and 461 of the CC. As a consequence of these cumulative failures, the fact remains that the easement established in 2005 was never registered in the Registro Nacional, even though it affects the property right (because a transmission line crosses the property), in contravention of Article 459 subsection 2) of the Código Civil, which provides in pertinent part: “The following shall be registered in the Property Registry: …2) Instruments establishing, recognizing, modifying, or extinguishing rights of usufruct, use, habitation, easements, and any other rights in rem (derechos reales) other than mortgages…” (emphasis not in the original).
Article 461 of the same Code, in turn, states: “Easements shall be recorded in the property registrations of the dominant estate (predio dominante) and the servient estate (predio sirviente).” Such registration in the Registro Nacional is necessary for an act transferring or encumbering rights in rem, such as an easement, to be effective against a third party. Thus, because the easement established between EPR and Nombre137178 appears neither on survey plans registered in the Catastro Nacional nor in the Registro Nacional, it is not enforceable against third parties, as follows from Articles 455, 459, and 461 ibídem. The Court finds that the defendant Nombre137177 is indeed a third party, insofar as he was not a party to the private contract executed in 2005 by EPR and Nombre137178, and that he acquired the property in 2018—that is, more than ten years after that private agreement was executed—in reliance on the registry information and public notice (publicidad registral) concerning the property registered in the Registro Nacional, Partido de Puntarenas, under real-property folio registration Placa25594, which did not reflect the registration of any easement.
Accordingly, that encumbrance cannot be enforced against him, nor can he be required to establish it by public deed (escritura pública) so that it may now be registered in the Registro Nacional, as it should have been since 2005. At this point, the Court must emphasize that, because EPR is a company that administers a public service—in this case, the supply of electricity through the generation, transmission, distribution, and commercialization stages—it was required to act in accordance with the principle of legality (bloque de legalidad). This obligated it not only to establish the easement and compensate the owner of the servient estate, but also to record and register that encumbrance in the Registro Nacional against the servient estate, so that the encumbrance would be covered by public registry notice and thus enforceable against third-party purchasers. Accordingly, had the plaintiff company acted diligently, it would have sought to ensure that Nombre137178 registered the easement as required, taking the appropriate measures for that purpose, including compelling performance of the agreement entered into in 2005; this would have rendered the filing of this action unnecessary.
Yet it is precisely due to the failures attributable to EPR and Nombre137178 that the existence of the encumbrance does not appear in the Registry, which means that the defendant Nombre137177 acquired the property in question in 2018, we reiterate, in reliance on public registry notice and without any record of the easement established in 2005. In our view, because the easement was not registered in the Registro Nacional, what has existed is a situation of tolerance by the subsequent owners—formerly Nombre137181 and currently the defendant Nombre137177—which in no way releases EPR, in its capacity as the administrator of a public service, from the particular and specific obligations that, we repeat, the legal system imposes for establishing an easement over a third party’s estate; nor does it permit the current owner of the property to be compelled to consent to an encumbrance established in 2005 by another person that was not recorded in the Registro Nacional when he acquired the property.
The plaintiff company bases its theory of the case on arguments that, in our view, cannot be accepted. At the outset, and for the reasons set forth ut supra, the mere fact that the easement was established and compensation paid does not support the conclusion that it is enforceable against third parties—in this case, against the defendant Nombre137177—because such enforceability requires its registration, as may be inferred from Articles 455, 459 subsection 2), and 461 of the CC. No such registration occurred, because he acquired the property free of that encumbrance according to the information appearing in the Registro Nacional, as was stated in the public deed by which he acquired the property. The plaintiff company acknowledges that the easement was not registered but asserts that it was shown on the easement route (trazado de la servidumbre) prepared by it in 2005 and that at least the tower site was depicted on plan 6-1792842-2015.
However, we, the judges of this Court, find that the easement route prepared by EPR in 2005, which this Court has found established as proven fact 2, is insufficient to support requiring the defendant herein to consent by public deed to the encumbrance in question for its subsequent registration because, ultimately, the easement as such was not recorded in this case either on plan 6-1792842-2015, registered in the Catastro Nacional, or in the Registro Nacional. Furthermore, the alleged irregularities that the plaintiff attributes to that plan likewise cannot be accepted, because they all arise from the purported violation of Article 34 subsection e) of the Reglamento a la Ley del Catastro Nacional, without the plaintiff having sought the nullification of the plan in question in these proceedings, which prevents the Court from determining whether that graphical representation complies with the law.
In addition, it must be borne in mind that the nature of the easement—in this case, continuous and apparent (continua y aparente)—is not disputed in these proceedings, since the defendant himself admits that he learned of it when he acquired the property and that he has even allowed employees of the plaintiff company to enter his property to maintain it. Nevertheless, we find that the continuous and permanent nature of the easement established in 2005 is likewise insufficient to compel the defendant herein to consent to it and appear for its registration in the Registro Nacional. This is because, we reiterate, as the administrator and provider of a public service, EPR was required to comply with the formalities and procedures established by the legal system for the establishment of easements, including their proper registration in the Registro Nacional so as to provide third parties with notice of the existence of the encumbrance in question.
The contrary would lead to the conclusion that, in cases involving continuous and apparent easements (servidumbres continuas y aparentes) required for the provision of public services, registration (inscripción) in the Registro Nacional would not be necessary to provide notice to third parties, because they are visible encumbrances (gravámenes) whose physical manifestation makes their existence ascertainable; this Tribunal does not share that interpretation. This is because, for the reasons already stated, it would entail disregarding the legal provisions that clearly establish the permissible procedures for creating easements (servidumbres), such as the one at issue here, and because it would create uncertainty for third-party purchasers. For the same reasons, the Tribunal also rejects the plaintiff company’s argument that the defendant acquired the property subject to the obligations already assumed by Mr.
Nombre137178. We reiterate that defendant Nombre137177 did not enter into any easement agreement with the EPR and that, because the encumbrance was not registered in the Registro Nacional, he acquired the property in the Partido de Puntarenas, real-property folio registration number (matrícula de folio real) Placa25594, free of any easement, as stated in the deed (escritura) executed for that purpose. Finally, we find that the claimant’s argument that the easement has not been extinguished is likewise insufficient to require defendant Nombre137177 to consent to the encumbrance in question by public deed (escritura pública) for its subsequent registration, because, as we have emphasized, that encumbrance was never registered in the Registro Nacional and therefore cannot affect third parties who acquire property in reliance on public notice through the registry (publicidad registral), as occurred in this case.
Ultimately, the person from whom performance of the agreement entered into in 2005—whether specific or substitute performance (cumplimiento forzoso o sustitutivo)—could be demanded is the person who undertook that obligation and received the corresponding compensation for the encumbrance, in this case, Mr. Nombre137178. In view of all the foregoing, the principal claim seeking a declaration that the defendant is required to execute the instrument creating the easement encumbrance for the passage of the electric power transmission line in favor of the EPR and over his property, registration number Placa25589, on the same terms stipulated by Mr. Nombre137178 in 2005, must be denied. If the EPR needs to register the aforementioned easement, it must comply with the procedures and formalities required by the legal system for that purpose; in this case, the defendant cannot be compelled to consent to an encumbrance created by another person that was never registered in the Registro Nacional.
VI.The claimant also asserts three alternative claims. The first seeks, in the event that the defendant refuses to execute the instrument, to have it executed by a judicial authority during the judgment-enforcement stage. Strictly speaking, this claim depends on the principal claim, insofar as it presupposes that the Court has declared the defendant herein obligated to execute the instrument establishing the easement encumbrance (gravamen de servidumbre), under the same terms stipulated by Mr. Nombre137178 in 2005, and that he has refused to comply with the judicial ruling. However, for the reasons stated in the preceding Considerando, the Court has already deemed it improper to impose the aforementioned obligation on defendant Nombre137177 and has denied the principal claim. The denial of that request logically entails that establishing the easement (servidumbre) by judicial judgment, as sought by the claimant, is likewise improper.
The second alternative claim seeks a declaration that EPR acquired by acquisitive prescription (prescripción positiva), pursuant to Articles 378 and 868 of the Código Civil, the easement right for the passage of an electric power transmission line over the defendant’s property, registration number Placa25589, and that the certified judgment be forwarded to the Registro Público for registration of the easement right under the same terms on which Mr. Nombre137178 imposed the easement in 2005. We find, however, that the relief sought is improper for several reasons. First, this Court has already held, among other rulings, in judgment No. 092-2019-VI, issued at 15 hours 50 minutes on 30 de julio del 2019, that the Public Administration (in the broad sense) cannot acquire real rights (derechos reales) through adverse possession (usucapión) by acquisitive prescription, because doing so would contravene the principle of legality, given that no provision authorizes public entities to acquire real property through this legal mechanism.
On the contrary, we reiterate, under constitutional mandate—section 45—they are required to complete the prior expropriation procedures. In the case before us, the acquisitive prescription (prescripción adquisitiva) claimed concerns the public service administered by EPR and seeks acquisition by adverse possession of the easement right established in 2005 over the property now owned by the defendant herein, who, we reiterate, did not undertake to establish it and instead acquired the property free of encumbrances pertaining to easements. Thus, in our view, granting the relief sought would lead us to endorse the possibility that EPR, in performing functions related to the administration of a public service, could acquire an easement right by adverse possession through the passage of time—an interpretation that the Court in no way shares. The inability of public entities, those exercising public powers, or those providing public services to acquire property by adverse possession is an issue already addressed in the case law of the Sala Primera de la Corte Suprema de Justicia.
Thus, for example, in judgment No. 001259-F-S1-2009, issued at 10 hours 50 minutes on 10 de diciembre del 2009, that Chamber stated: “(...) the State cannot acquire real property through this legal mechanism, precisely because it has sufficient sovereign powers at its disposal, including expropriation, to acquire property necessary for fulfilling public purposes. Regarding the inapplicability of adverse possession where the purported acquirer is the State, this Chamber, in judgment no. 966 at 14 hours 10 minutes on 15 de diciembre de 2005, held: ‘In this regard, it must be noted that the Public Administration generally—centralized and decentralized—must conform its conduct to the body of legality (bloque de legalidad) enshrined in sections 11 of the Constitución Política and 11 of the LGAP. In this respect, the Constitución Política, in section 45, establishes the principle of the inviolability of private property, except for a legally established public interest and upon prior compensation in accordance with law.
Likewise, Ley número 6313 del 4 de enero de 1979, Ley de Adquisiciones, Expropiaciones y Servidumbres del ICE, section one, provides: “Real property, whether entire properties, portions thereof, rights, or legitimate property interests, whose location makes them necessary, in the judgment of the Instituto Costarricense de Electricidad, for the fulfillment of its purposes, is hereby declared to be of public utility. Such real propety (sic) may be expropriated in accordance with this law, regardless of its owner.” (Underlining not in the original) Section 22 thereof, in turn, provides: “The provisions of this law apply to the establishment of compulsory easements (servidumbres forzosas) for the installation of electric power and telecommunications lines, as well as for the direct or indirect fulfillment of any other purpose entrusted to ICE.” (Underlining supplied). It follows clearly from both provisions that, for ICE to establish compulsory easements for the installation of electric power and telecommunications lines, where the owner of the affected property objects, it must necessarily follow the expropriation procedure established in that legislation.
Obviously, if the owner of the property agrees, such a procedure is unnecessary. Nevertheless, pursuant to the provisions of (sic) Article 23 thereof, in relation to sections 455 and 461 of the Código Civil, even in that circumstance, and for purposes of third parties, it must be recorded in the property registration of the servient estate (fundo sirviente). It is readily apparent that the defendant institution cannot invoke the mere passage of time—adverse possession—as its title for acquiring the land on which an encumbrance of this kind is located, as it did in the referenced official communication, without violating the aforementioned principle of legality and the provisions transcribed above. (...)’” In addition, EPR itself failed to act diligently in seeking and overseeing the proper registration with the Registro Nacional of the easement established in 2005; this constitutes a violation of the rules and procedures established by the legal system for creating easements.
In our view, the foregoing demonstrates an absence of good faith (buena fe), precisely because EPR failed to comply with the procedure established by the legal system for creating the easement. Accordingly, recognizing acquisitive prescription of an unregistered easement right against third parties would also entail condoning and legitimizing conduct constituting an unlawful administrative act (vía de hecho), contrary to the good faith that must prevail in such cases, which this Court could in no way endorse. The final alternative claim seeks a declaration that the defendant herein is obligated to comply with the terms and conditions agreed upon when the easement right was established in 2005. This request must likewise be denied for the reasons already stated in the preceding Considerando, principally because defendant Nombre137177 neither established nor undertook to establish an easement in favor of EPR, which, in any event, was not registered with the Registro Nacional; accordingly, when he acquired the property, he did so free of annotations and encumbrances pertaining to easements.
Holding otherwise would impose upon him an encumbrance to which another person consented and which was not duly publicized in the Registro Nacional, which, in our view, is contrary to the administrative legal system and sections 455, 459 subsection 2), and 461 of the CC. Consequently, and for the reasons stated, the alternative claims must be denied, as they hereby are.
VII.Regarding the substantive prerequisites for the action, to be reviewed sua sponte (presupuestos materiales de la acción, de pronunciamiento oficioso). Defendant Nombre137177 did not raise any defenses (excepciones); accordingly, the Court proceeds with a sua sponte analysis of the prerequisites required for bringing the action and rendering judgment. In that regard, the Court finds that standing (legitimación) is satisfied because the claimant company brought this proceeding to protect its rights pursuant to Article 10 subsection 1(a) of the CPCA, against defendant Nombre137177, on the basis that he is the person obligated to provide the relief sought, as required by section 12 of the CPCA. Furthermore, a present interest (interés actual) is evident because judicial assistance is required to compel the defendant to execute an instrument so that an easement may be registered with the Registro Nacional. However, for the reasons stated in the preceding Considerandos, we find that the claimant company has no legal right to the relief sought; accordingly, both the principal and alternative claims must be denied under the terms stated. Consequently, the action must be dismissed, as it hereby is.
VIII.Regarding costs (costas). Pursuant to section 193 of the CPCA, costs are a burden imposed on the unsuccessful party by virtue of its having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, this collegiate body finds no reason to apply the exceptions established by the applicable legislation and depart from the principle that costs are awarded against the unsuccessful party. Therefore, the costs of the proceeding are imposed on the unsuccessful claimant company and shall be assessed during the judgment-enforcement stage once this ruling becomes final.
POR TANTO
A lack of legal right, found sua sponte, is declared with respect to both the principal and alternative claims asserted by Empresa Propietaria de la Red S.A. against Nombre137177. Consequently, the action is dismissed in all respects. The costs shall be borne by the unsuccessful claimant company and shall be assessed during the judgment-enforcement stage once this ruling becomes final. Cynthia Abarca Gómez. Proceso declarado de puro derecho establecido por EMPRESA PROPIETARIA DE LA RED S.A. (en adelante EPR), cédula jurídica CED108665, representada por su apoderado generalísimo sin límite de suma Nombre113345 , casado, ingeniero, cédula de identidad CED108666 y vecino de Escazú en contra de Nombre137177 , casado una vez, cédula de identidad CED108667 y vecino de Esparza. Participan los Licenciados Claudio Zeledón Rovira, Tomás Esquivel Cerdas y Mario Alberto Solano Rodríguez, en condición de apoderados especiales judiciales, los dos primeros de la parte actora y el último del demandado, respectivamente.
RESULTANDO
CONSIDERANDO
I.Hechos probados. De relevancia para efectos del presente proceso, se tienen por demostrados los siguientes:
II.Hechos no probados. Por no haber prueba en el expediente que lo sustente, se tiene por indemostrado lo siguiente: 1) El título que sustentó la inscripción del inmueble descrito en el hecho probado uno, en el Registro Nacional bajo la matrícula del Partido de Puntarenas Placa25590. 2) El título que sustentó la inscripción de los inmuebles matrícula Placa25591, Placa25592 y Placa25593 (ya cerrados), todos del Partido de Puntarenas. 3) Los planos que sustentaron la inscripción de los inmuebles inscritos en el Registro Nacional bajo las matrículas Placa25590, Placa25591, Placa25592 y Placa25593 (las tres últimas ya cerradas), todas del Partido de Puntarenas y si en ellos se hizo constar la existencia de la servidumbre de tendido eléctrico que consintió el señor Nombre137178 en favor de SIEPAC. 4) El título que sustentó la inscripción del inmueble del Partido de Puntarenas, matrícula de folio real Placa25594, a nombre de Nombre137181 . 5) Si el señor Nombre137178 comunicó a la señora Nombre137181 o al señor Nombre137177 la existencia de la servidumbre por él consentida y a la que se hace referencia en el hecho probado uno.
III.Objeto del proceso. La sociedad demandante formula pretensiones principales y subsidiarias. En lo medular, la primera de ellas se dirige a que se declare que el aquí demandado está obligado a suscribir, en su favor, la escritura de constitución del gravamen de servidumbre para el paso de la línea de transmisión de energía eléctrica sobre la finca de su propiedad inscrita en el Registro Nacional, Partido de Puntarenas, matrícula de folio real Placa25594, en los mismos términos en que se estipuló por el señor Nombre137178 en el año 2005. Subsidiariamente, formula tres pedimentos. El primero de ellos es para que, en caso que el demandado se niegue a esa suscripción, se disponga que la escritura será otorgada por una autoridad judicial, en la etapa de ejecución de sentencia. También pretende que se declare que adquirió el derecho de servidumbre para el paso de línea de transmisión de energía eléctrica, sobre la finca del demandado, inscrita en el Registro Nacional, Partido de Puntarenas, matrícula de folio real Placa25594, por prescripción positiva, de acuerdo con lo estipulado en los artículos 378 y 868 del Código Civil y se remita al Registro Público, la ejecutoria para la inscripción del derecho de servidumbre, en los mismos términos en que impuso la servidumbre el señor Nombre137178 , en el año 2005.
Finalmente, pide que se declare que el demandado se encuentra obligado a respetar los términos y condiciones en que se pactó la constitución del derecho de servidumbre en el año 2005. El accionado Nombre137177 se opuso a la demanda, pero no formuló excepciones. Para lo que se considera un mejor orden, se abordará el examen de legalidad de lo pretendido, en atención a los ejes temáticos que en sus argumentos plantean la demandante y el accionado, a fin de evitar reiteraciones innecesarias, con el correspondiente análisis, claro está, de todo lo argüido.
IV.Sobre el caso concreto. Para una mejor compresión de lo que se resolverá, estimamos que resulta indispensable referirse brevemente a la naturaleza de la sociedad accionante y el régimen jurídico al que se encuentra sometida. En ese sentido y como antecedente, debemos hacer referencia al “Tratado Marco del Mercado Eléctrico de América Central y su Protocolo”, suscrito por los gobiernos de Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua y Panamá y que, en nuestro país, fue aprobado por la Ley Nº 7848 del 20 de noviembre de 1998. El referido tratado tiene por objeto la formación y crecimiento gradual de un Mercado Eléctrico Regional competitivo, basado en el trato recíproco y no discriminatorio, que contribuya al desarrollo sostenible de la región dentro de un marco de respeto y protección al medio ambiente (artículo 1). En el numeral segundo se establecen los fines de ese instrumento regional, dentro de los que interesa destacar que se busca establecer las condiciones para el crecimiento del Mercado Eléctrico Regional, para que se abastezca en forma oportuna y sostenible la electricidad requerida para el desarrollo económico y social; impulsar la infraestructura de interconexión necesaria para el desarrollo del Mercado Eléctrico Regional; crear las condiciones necesarias para propiciar niveles aceptables de calidad, confiabilidad y seguridad en el suministro de energía eléctrica en la región y propiciar que los beneficios derivados del mercado eléctrico regional lleguen a todos los habitantes de los países de la región.
En lo que interesa, el ordinal 15 dispone que "(...) Cada Gobierno designará a un ente público de su país para participar en una empresa de capital público o con participación privada con el fin de desarrollar, diseñar, financiar, construir y mantener un primer sistema de transmisión regional que interconectará los sistemas eléctricos de los seis países. Su pacto social de constitución asegurará que ningún socio pueda poseer un porcentaje de acciones que le den control mayoritario de la sociedad. Esta empresa denominada Empresa Propietaria de la Red (EPR), estará regida por el derecho privado y domiciliada legalmente en un país de América Central. (...)” (el resaltado no corresponde al original). En el caso de Costa Rica, debemos indicar que conforme al artículo 3 de la Ley N° 9004 del 31 de octubre del 2011, que “Aprueba el Segundo Protocolo al Tratado Marco del Mercado Eléctrico de América Central", se dispuso que los únicos agentes del mercado eléctrico regional por Costa Rica son el Instituto Costarricense de Electricidad (ICE) y sus empresas, de conformidad con lo dispuesto en el inciso b) del artículo 6 de la Ley N.º 8660, Fortalecimiento y Modernización de las Entidades Públicas del Sector Telecomunicaciones, de 8 de agosto de 2008.
Lo anterior encuentra sustento en las propias manifestaciones de la sociedad accionante, quien explica que los socios que integran la EPR por nuestro país son el ICE y la Compañía Nacional de Fuerza y Luz. Teniendo en cuenta lo anterior, debemos referirnos nuevamente al Tratado Marco, que en su artículo 31 señala que "(...) Los entes públicos de los países miembros dedicados a cualquiera de las actividades de generación, transmisión, distribución y comercialización de la energía eléctrica quedan autorizados para: (...) b) Suscribir la compra de acciones en la sociedad mercantil que construya la primera línea regional de interconexión. A tal efecto, podrá efectuar aportes en efectivo y no monetarios, tales como terrenos, derechos de servidumbre, diseños, topografía y otros. (...)” . A esta altura, también resulta fundamental tener presente que de conformidad con el artículo 5 de la Ley No. 7593 del 9 de agosto de 1996, en nuestro país, el suministro de energía eléctrica en las etapas de generación, transmisión, distribución y comercialización constituye un servicio público.
Lo anterior es importante porque si bien conforme al ordinal 15 del Tratado ya mencionado, la EPR se rige por el Derecho Privado; no puede este Tribunal obviar que si es la encargada de ejecutar el proyecto de interconexión para la generación y transmisión eléctrica regional de los países de América Central (artículos 7 al 17 del mismo Tratado), resulta innegable que administra y presta un servicio público. Así lo ha reconocido la Sala Primera de la Corte Suprema de Justicia, por ejemplo, en la resolución No. 1534-C-S1-2013 dictada a las 11 horas 50 minutos del 7 de noviembre del 2013, en la cual dispuso residenciar en esta Jurisdicción Contencioso Administrativa y Civil de Hacienda (y no en la Jurisdicción Civil) las pretensiones aún de carácter civil que planteara la EPR, sustentando esa decisión en que "(...) si bien es cierto, corresponde a una sociedad de carácter privado, es propiedad de las seis empresas eléctricas públicas de América Central, según lo autorizó el Tratado Marco del Mercado Eléctrico de América Central, ratificado por Costa Rica, mediante Ley no. 7848 de 1998; además, esa sociedad administra un servicio público, y es propietaria de una Línea de Transmisión eléctrica a lo largo del istmo centroamericano.
Producto de lo anterior, existe un evidente interés estatal en este asunto (...)" (el resaltado no corresponde al original). Además, según se indicó supra, sus accionistas son precisamente dos instituciones publicas: el ICE y la CNFL. Se está entonces en la figura de una empresa pública conformada como ente de derecho privado -sociedad anónima. A partir de lo expuesto, el Tribunal está convencido de que en el ejercicio de las potestades relativas al servicio público que presta, la EPR debe actuar sometida y subordinada al principio de legalidad, que sujeta la actuación de las Administraciones Públicas y se constituye en un pilar esencial del cualquier Estado Social y Democrático de Derecho, que encuentra sustento en los numerales 11 de la Constitución Política y de la Ley General de la Administración Pública (en adelante LGAP). Ello implica que las actuaciones que despliegue para la administración y prestación del servicio público, están sometida a todo el ordenamiento jurídico administrativo.
En el caso que nos ocupa, y según analizaremos infra, el sometimiento de esa actuación de la EPR al bloque de legalidad y los procedimientos y formas ahí reglados, adquiere una particular importancia dada su incidencia en la garantía a la inviolabilidad de la propiedad privada, que establece, como regla general, el artículo 45 de la Constitución Política. La norma constitucional también señala, a modo de excepción, por una parte, la obligación por parte del Estado (en sentido amplio) de indemnizar al propietario previamente cuando deba suprimirla por razones de "interés público legalmente comprobado", para lo cual deberá acudir al ejercicio de la potestad expropiatoria conforme al procedimiento arbitrado por el ordenamiento jurídico. Por otra parte, el párrafo segundo del ordinal 45 constitucional regula la posibilidad de establecer limitaciones de interés social a la propiedad, mediante ley aprobada por votación calificada.
De lo expuesto, el Tribunal entiende claramente que, en ejercicio de potestades referidas al servicio público que le ha sido encomendado, la EPR requiera, entre otras labores, imponer servidumbres de paso de línea eléctrica de transmisión que le permita colocar las estructuras (líneas, postes, torres, equipos y aditamentos) y conductores de una línea de transmisión para luego darles mantenimiento, en terrenos pertenecientes a otros propietarios. Sin embargo, estimamos que la imposición de estas servidumbres debe serlo dentro del absoluto respeto al bloque de legalidad; máxime cuando, reiteramos, éstas que constituye un gravamen que recae sobre la propiedad de un bien inmueble, en favor o para la utilidad de un tercero o de un predio; y en este caso, para beneficio de la colectividad en general, al tratarse de implementos para el correcto funcionamiento de líneas de transmisión y distribución de la energía eléctrica.
A partir de lo expuesto, estimamos que son dos los posibles escenarios que pueden plantearse. El primero de ellos es que la EPR, previa negociación con los propietarios de derechos sobre el inmueble que pretenda gravarse, constituya la servidumbre en cuestión y compense económicamente a los titulares del fundo sirviente. Lo anterior porque la servidumbre impone al propietario del bien sobre el cual se constituye, la obligación de soportar una carga que comprende obligaciones de no hacer y de tolerar, todo ello en beneficio de un tercero u otro predio y según se dijo antes, en este caso en favor de la colectividad en general; el cual adquiere la posibilidad de servirse y utilizar el bien para los fines estipulados en la constitución de la misma. En ese tanto, es innegable su incidencia en el derecho de propiedad, tal cual se infiere de los artículos 370 a 378 del Código Civil (en adelante CC).
Asimismo, deberá posteriormente inscribir la servidumbre en el Registro Nacional, a efectos de dotarlas de publicidad registral y que surtan efectos ante terceros, según se colige de los numerales 455, 459 inciso 2) y 461 del CC. Un segundo escenario se presentaría en el evento de que la EPR no obtuviera el consentimiento de los propietarios para constituir la servidumbre y que exista un interés público en ello. En este supuesto, resulta claro que la ejecución del proyecto SIEPAC requeriría del aporte de propiedades inmuebles, lo que a su vez, implicaría expropiar a los titulares de los fundos afectados. En este caso, en aplicación del artículo 31 del Tratado, sería el ICE quien tendría que instar los trámites y procedimientos correspondientes; de conformidad con lo dispuesto, entre otros, en los numerales 1 y 22 de la Ley No. 6313 del 4 de enero de 1979 (Ley de Adquisiciones, Expropiaciones y Servidumbres del ICE).
De ambas disposiciones, se colige con claridad que, para constituir servidumbres forzosas para el tendido de líneas eléctricas y de telecomunicaciones, en caso de oposición del propietario del fundo afectado, debe, necesariamente, seguirse el procedimiento expropiatorio dispuesto en dicha normativa. Obviamente, si el dueño del fundo se muestra conforme, resulta innecesario tal proceder. Sin embargo, a tenor de lo dispuesto de el artículo 23 de la Ley No. Placa6506 citada en relación con los cánones 455, 459 inciso 2) y 461 del CC, aún en este supuesto, y para efectos de terceros, debe anotarse en la inscripción de propiedad del fundo sirviente. Partiendo de lo expuesto, se ingresa al examen de lo debatido.
V.La pretensión principal que formula la sociedad accionante es, en lo medular, para que se declare "(...) que el aquí demandado está obligado a suscribir la escritura de constitución del gravamen de servidumbre, para el paso de la línea de transmisión de energía eléctrica, a favor de mi representado, sobre la finca de su propiedad matrícula Placa25589, en los mismos términos en que se estipuló por el señor Nombre137178 en el año 2005; (...)". Sin embargo, en criterio del Tribunal este pedido no resulta atendible por las siguientes razones. De conformidad con los hechos probados 1 y 3 de esta sentencia, en este proceso, no existe controversia en cuanto a la constitución de una servidumbre permanente a favor de la EPR, para el paso de la línea de transmisión propiedad de la EPR (proyecto SIEPAC) mediante la cual se trasegaría la energía eléctrica que adquiera de generadores privados o bien de las diferentes plantas que instale en el país y fuera de él, y de paso a pie o en vehículo; en el inmueble que hoy es propiedad del aquí demandado.
Esa servidumbre fue constituida por medio de un contrato privado, sin fecha cierta, suscrito el 19 de marzo del 2005, entre la EPR y Nombre137178 , quien en aquel momento era el poseedor del inmueble, el cual no estaba inscrito en el Registro Nacional. Se ha tenido por demostrado, también, que al momento de la suscripción del contrato de servidumbre, la EPR indemnizó al señor Nombre137178 por el tramo de su terreno que ocuparía la servidumbre y posteriormente, el 3 de noviembre del 2007, también se le indemnizó por la instalación de un sitio de torre, para el soporte y elevación de los cables eléctricos de la línea de transmisión eléctrica (hechos probados 1 y 3). Finalmente, en el contrato indicado, el señor Nombre137178 se comprometió a respetar lo convenido y a que en caso de que vendiera el predio o parte de éste, comunicaría al comprador sobre la servidumbre que estaba constituyendo (hecho probado 1).
No obstante, también se ha tenido por demostrado que posteriormente, el señor Nombre137178 inscribió en el Registro Nacional el inmueble en el cual había consentido la imposición de la servidumbre, bajo la matrícula del Partido de Puntarenas Placa25590, sin hacer constar la existencia de aquella, de modo que el inmueble se registró sin anotaciones y únicamente con gravámenes referidos a reservas de la Ley de Caminos y la de Aguas (hecho probado 4). Tampoco hizo constar la existencia de la servidumbre indicada, cuando de ese inmueble surgieron las fincas inscritas bajo las matrículas de folio real Placa25591, Placa25592 y Placa25593 (hecho probado 5); ni en la posterior reunión de éstas, lo cual se materializó en el plano inscrito en el Catastro Nacional bajo el número 6-1792842-2015, en el cual tampoco se hizo constar la existencia de ninguna servidumbre sino que únicamente cita la existencia de una torre (hecho probado 6).
Lo anterior tuvo como consecuencia que, posteriormente, el inmueble surgido de la reunión de aquellas tres fincas, ahora identificado con la matrícula de folio real Placa25594, fuera inscrito a nombre de Nombre137181 el 24 de abril del 2015, sin anotaciones y, nuevamente, sin ninguna servidumbre ya que solo constaban gravámenes referidos a las reservas de la Ley de Caminos, la de Aguas, una hipoteca y un embargo practicado (hecho probado 7). Finalmente, el 31 de enero del 2018, la señora Nombre137181 vendió al demandado Nombre137177 el inmueble inscrito en el Registro Nacional, Partido de Puntarenas, matrícula de folio real Placa25594, soportando los gravámenes de reserva de la Ley de Caminos y de la Ley de Aguas, y la hipoteca, así como la anotación del practicado que indica Registro, pero libre de todo otro tipo de anotaciones (hecho probado 8). Es decir, ni en la escritura ni en el Registro Nacional se hizo constar la existencia de ninguna servidumbre que afectara el referido inmueble.
En definitiva, al 18 de noviembre del 2019, el propietario registral del inmueble inscrito en el Registro Nacional, Partido de Puntarenas, matrícula de folio real Placa25594 es el demandado Nombre137177 y conforme a la información registral, ese inmueble no tiene anotaciones y los únicos gravámenes que constan refieren a las mencionadas reservas de la Ley de Caminos y la de Aguas (hecho probado 9). De este recuento fáctico, el Tribunal arriba diversas conclusiones que son las que sirven de basamento a la decisión de rechazar lo pedido por la sociedad demandante. La primera de ellas es que, a pesar de que la EPR constituyó la mencionada servidumbre en un contrato privado e indemnizó a quien era el titular por soportar ese gravamen; el señor Nombre137178 no la inscribió cuando matriculó por primera vez el inmueble en el Registro Nacional, ni en los posteriores movimientos y traspasos registrales.
A la omisión del señor Nombre137178 se une la de la EPR, quien durante todos estos años tampoco mostró la diligencia debida ni procuró que ese gravamen se inscribiera, para darle publicidad ante terceros, tal cual lo exigen los artículos 455, 459 inciso
VI.La parte accionante plantea, también, tres pretensiones subsidiarias. La primera de ellas es para que, en caso que el demandado se niegue a esa suscripción, la escritura sea otorgada por una autoridad judicial, en la etapa de ejecución de sentencia. En rigor, esta pretensión pende de la principal en tanto supone que el Tribunal haya declarado la obligación del aquí demandado de suscribir la escritura de constitución del gravamen de servidumbre, en los mismos términos en que se estipuló por el señor Nombre137178 en el año 2005, y que él se negara a cumplir con el pronunciamiento judicial. Sin embargo, por las razones expuestas en el Considerando previo, ya el Tribunal estimó improcedente imponer al accionado Nombre137177 la obligación mencionada y denegó la pretensión principal. El rechazo de ese pedimento trae como consecuencia lógica que también resulte improcedente constituir la servidumbre por sentencia judicial, como pretende la accionante.
La segunda de las pretensiones subsidiarias es para que se declare que la EPR adquirió el derecho de servidumbre para el paso de línea de transmisión de energía eléctrica, sobre la finca del demandado, matrícula Placa25589, por prescripción positiva, de acuerdo con lo estipulado en los artículos 378 y 868 del Código Civil, y se remita al Registro Público, la ejecutoria para la inscripción del derecho de servidumbre, en los mismos términos en que impuso la servidumbre el señor Nombre137178 , en el año 2005. Sin embargo, estimamos que lo pedido es improcedente por varias razones. La primera de ellas ya este Tribunal se ha decantado, entre otras, en la sentencia No. 092-2019-VI dictada a las 15 horas 50 minutos del 30 de julio del 2019, por rechazar la posibilidad de que la Administración Pública (en sentido amplio) pueda usucapir, por prescripción positiva, derechos reales; porque ello sería contraria al principio de legalidad, dado que no existe norma alguna que posibilite a los entes públicos a adquirir un bien inmueble por medio de este instituto.
Por el contrario, insistimos, se encuentran obligados, por mandato constitucional –numeral 45- a efectuar los trámites previos de expropiación. En el caso que nos ocupa, la prescripción adquisitiva que se reclama lo es en relación con el servicio público que administra la EPR y a efectos de usucapir el derecho de servidumbre que fue constituido en el 2005 en el inmueble que hoy es propiedad del aquí accionado, quien reiteramos, no se obligó a constituirlo y más bien lo adquirió libre de gravámenes referidos a servidumbres. De esta forma, en nuestro criterio, acoger lo pretendido nos llevaría a avalar la posibilidad de que la EPR, en ejercicio de funciones relativas a la administración de un servicio público, pueda usucapir por el transcurso del tiempo, un derecho de servidumbre; interpretación que de ninguna manera comparte el Tribunal. La imposibilidad de que los entes públicos, quienes ejerzan potestades públicas o presten servicios públicos puedan usucapir, es un aspecto que ya ha sido abordado por la jurisprudencia de la Sala Primera de la Corte Suprema de Justicia.
Así, por ejemplo, en la sentencia No. 001259-F-S1-2009 dictada a las 10 horas 50 minutos del 10 de diciembre del 2009, esa Sala indicó "(...) el Estado no puede adquirir bienes inmuebles por medio de este instituto, precisamente porque tiene a su disposición suficientes potestades de imperio, incluida la expropiación, a fin de adquirir aquellos necesarios para el cumplimiento de los fines públicos. Sobre la improcedencia del instituto de la usucapión, cuando el presunto adquirente sea el Estado, esta Sala, en sentencia no. 966 de las 14 horas 10 minutos del 15 de diciembre de 2005, estimó: “Al respecto, precisa anotar que la Administración Pública en general –central y descentralizada- debe adecuar su proceder al bloque de legalidad, consagrado en los numerales 11 de la Constitución Política y 11 de la LGAP. En este sentido, la Constitución Política, en el canon 45, establece el principio de la inviolabilidad de la propiedad privada, salvo por interés público legalmente comprobado, y previa indemnización conforme a la ley.
Asimismo, la Ley número 6313 del 4 de enero de 1979, Ley de Adquisiciones, Expropiaciones y Servidumbres del ICE, ordinal primero, dispone: “Decláranse de utilidad pública, los bienes inmuebles, sean fincas completas, porciones, derechos o intereses patrimoniales legítimos, que por su ubicación sean necesarios, a juicio del Instituto Costarricense de Electricidad, para el cumplimiento de sus fines. Estos beines (sic) inmuebles podrán ser expropiados conforme a esta ley, quienquiera sea su dueño.”(Lo subrayado no es del original) Por su parte, el numeral 22 ibídem, preceptúa: “Las disposiciones de esta ley son aplicables a la constitución de servidumbres forzosas para el tendido de las líneas eléctricas y de telecomunicaciones, así como para el cumplimiento directo o indirecto de cualquier otro fin encomendado al ICE.”(Lo subrayado es suplido). De ambas disposiciones, se colige con claridad que, para que el ICE pueda constituir servidumbres forzosas para el tendido de líneas eléctricas y de telecomunicaciones, en caso de oposición del propietario del fundo afectado, debe, necesariamente, seguir el procedimiento expropiatorio dispuesto en dicha normativa.
Obviamente, si el dueño del fundo se muestra conforme, resulta innecesario tal proceder. Sin embargo, a tenor de lo dispuesto de (sic) el artículo 23 ejúsdem; en relación con los cánones 455 y 461 del Código Civil, aún en este supuesto, y para efectos de terceros, debe anotarse en la inscripción de propiedad del fundo sirviente. Resulta fácil concluir que la Institución demandada no puede invocar, como título adquisitivo del terreno donde se ubique un gravamen de este tipo, el simple transcurso del tiempo –usucapión-, tal como lo hizo en el indicado oficio, sin conculcar el principio aludido de legalidad, así como las normas antes transcritas. (...)". Aunado a lo anterior, lo cierto es que fue la propia EPR quien no fue diligente en procurar y supervisar la debida inscripción de la servidumbre constituida en el año 2005, ante el Registro Nacional; lo que supone un violación a las normas y procedimientos arbitrados por el ordenamiento jurídico para constituir servidumbres.
Lo anterior evidencia, en nuestro criterio, la ausencia de la buena fe, precisamente por no haber cumplido con el el procedimiento establecido en el ordenamiento jurídico para el establecimiento de la servidumbre. Por ello, avalar una prescripción positiva del derecho de una servidumbre no inscrita frente a terceros, supondría también consentir y legitimar una actuación constitutiva de la vía de hecho, opuesta a la buena fe que debe imperar en estos casos, que este Tribunal de ninguna manera podría avalar. La última de las pretensiones subsidiarias que se formula es para que se declare que el aquí demandado se encuentra obligado a respetar los términos y condiciones en que se pactó la constitución del derecho de servidumbre en el año 2005. Este pedido debe también ser rechazado por las razones ya expuestas en el Considerando anterior, en lo medular, porque el accionado Nombre137177 nunca constituyó ni se obligó a una servidumbre en favor de la EPR, la cual en todo caso, tampoco fue inscrita en el Registro Nacional; de modo que cuando él adquirió el inmueble, lo hizo libre de anotaciones y gravámenes referidos a servidumbres.
Lo contrario sería obligarlo por un gravamen consentido por otra persona y el cual no fue debidamente publicitado en el Registro Nacional, lo cual en nuestro criterio, resulta contrario al ordenamiento jurídico administrativo y a los numerales 455, 459 inciso 2) y 461 del CC. En consecuencia y por las razones expuestas, las pretensiones subsidiarias deben ser rechazadas, como en efecto se hace.
VII.Sobre los presupuestos materiales de la acción, de pronunciamiento oficioso. El demandado Nombre137177 no formuló excepciones, razón por la cual se procede con el análisis oficioso de los presupuestos requeridos para el ejercicio de la acción y el dictado de la sentencia. En ese sentido, observa el Tribunal que se satisface la legitimación porque la sociedad actora interpuso este proceso en tutela de sus derechos, al tenor del artículo 10 inciso 1 a) del CPCA; en contra del demandado Nombre137177 , al estimar que es él quien está obligado a lo que se pretende, tal cual lo exige el ordinal 12 del CPCA. Por otra parte, se evidencia la existencia del interés actual desde el momento en que se requiere el auxilio judicial para obligar al accionado a suscribir una escritura para poder inscribir una servidumbre en el Registro Nacional. Sin embargo, por las razones expuestas en los Considerandos previos, estimamos no asiste el derecho a la sociedad actora, razón por la cual deben rechazarse tanto las pretensiones principales como las subsidiarias, en los términos expuestos. En consecuencia, la demanda debe ser declarada sin lugar, como en efecto se hace.
VIII.Sobre las costas. De conformidad con el numeral 193 del CPCA, las costas constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, no encuentra este órgano colegiado motivo para aplicar las excepciones que fija la normativa aplicable y quebrar el postulado de condena al vencido. Por ende, se imponen las costas del proceso a la sociedad accionante que ha resultado vencida, las que deberán ser liquidadas en la fase de ejecución de sentencia una vez firme este pronunciamiento.
POR TANTO
Se declara una falta de derecho apreciada de oficio tanto en relación con las pretensiones principales como las subsidiarias que formula la Empresa Propietaria de la Red S.A. en contra de Nombre137177 . En consecuencia, se declara sin lugar la demanda en todos sus extremos. Son las costas a cargo de la sociedad accionante que ha resultado vencida, las que deberán ser liquidadas en la fase de ejecución de sentencia una vez firme este pronunciamiento.
