Respondent: MUNICIPALIDAD DE DESAMPARADOS No. 55-2022 TRIBUNAL CONTENCIOSO ADMINISTRATIVO. THIRD SECTION, ANNEX A OF THE II CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at eleven hours on February twenty-four, two thousand twenty-two.
Appeal filed by Inmobiliaria Tirrazú del Sur S.A., corporate identification number CED85091, represented by its general attorney-in-fact with unlimited authority, Ms. Marta Eugenia Muñoz Delgado, identity card number CED85092, against Resolution No. AM-125-16 of November 14, 2016, issued by the Mayor of Desamparados.
Judge Solano Ulloa delivers the opinion; and,
Whereas:
I.Preliminary matter. The challenged act of the Mayor of Desamparados applied the provisions contained in Plan GAM 2013-2030, set forth in Decreto Ejecutivo No. 38334-PLAN-MINAE-MIVAH-MOPT-SMAG, concerning the “Dense and Integrated Urban Centers,” which the appellant company challenges in its statement of grounds for appeal. The application of those provisions was suspended in its entirety by the Sala Constitucional, as ordered at 15:20 hours on January 28, 2015, in constitutional challenge No. 14-019525-0007-CO; for that reason, this case was stayed by this Chamber in an order issued at 9:20 hours on July 18, 2018. A search conducted on the Nexus website indicates that the action was decided in Sala Constitucional Judgment N° 023743 of December 9, 2020, the operative portion of which was published in Boletín Judicial No. 34, 35 and 36 on February 18, 19 and 22, 2021, although its full text has not been published as of this date. Subsequently, by Sala Constitucional Resolution N° 011958 of May 26, 2021, the operative portion of Judgment 2020-023743 was supplemented so that it would read, in its final form, as follows:
“Unanimously, the action is GRANTED. Consequently, Decreto Ejecutivo Nº 38334-PLAN-MINAE-MIVAH-MOPT-S-MOPT of March 10, 2014, is declared unconstitutional for violating the principle prohibiting the singular derogation of regulations (principio de inderogabilidad singular de las normas) and the right to a healthy and ecologically balanced environment, protected by Article 50 of the Constitución Política. This judgment shall have declaratory and retroactive effect as of the effective date of the annulled regulations, without prejudice to rights acquired in good faith. Nevertheless, pursuant to Article 91 of the Ley de la Jurisdicción Constitucional, the effects of the judgment are adjusted to avoid serious disruption to order and legal certainty, and Decreto Ejecutivo Nº 38334-PLAN-MINAE-MIVAH-MOPT-S-MOPT of March 10, 2014—the regulations declared unconstitutional—shall remain in force for up to thirty-six months following publication of the complete judgment in the official gazette La Gaceta, so that new regulations may be issued containing a strategic environmental assessment (evaluación ambiental estratégica) or another technical study that adequately incorporates the environmental variable into the plan at issue in this action, before the Secretaría Técnica Nacional Ambiental.
If this does not occur within that period, Decreto Ejecutivo N° 38334-PLAN-MINAE-MIVAH-MOPT-S-MAG of March 10, 2014, shall be deemed definitively removed from the legal system. Given the manner in which the matter is decided, no ruling is issued on the remaining substantive arguments raised in this action. Justice Cruz Castro provides additional reasons. Justice Castillo Víquez files a note. Justice Rueda Leal and Justice Hernández López file separate notes. Justice Garro Vargas dissents with respect to the adjustment of the effects of this judgment and, pursuant to Article 91 of the Ley de la Jurisdicción Constitucional, states that the Poder Ejecutivo must submit the plan provided for in the aforementioned decree to a strategic environmental assessment process or another study incorporating the environmental variable before the Secretaria Técnica Nacional Ambiental, which must issue the corresponding resolution.
All of the foregoing must be completed within a maximum period of thirty-six months calculated from the complete publication of this judgment in the Boletín Judicial. This ruling shall be enforced before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of the Código Procesal Contencioso Administrativo. The decree shall remain in force during the period granted. If the obligation imposed herein is not fulfilled within the stated period, the declaration of nullity shall take full legal effect. A copy of the judgment shall be forwarded to the Área de Ejecución del Tribunal de lo Contencioso Administrativo y Civil de Hacienda so that it may initiate proceedings to enforce this decision. Justice Garro Vargas also files a note. This ruling shall be communicated to the Poder Legislativo, Poder Ejecutivo and Poder Judicial, as well as to the institutions appearing in the case file.
A summary of this ruling shall be published in the official gazette La Gaceta, and the ruling shall be published in full in the Boletín Judicial. Notice shall be given.” As may be seen, the grounds for unconstitutionality have not yet been made known to third parties because the judgment has not been published. Nevertheless, since it is clear that the declared unconstitutionality of the Regulations will take effect on a future date in accordance with the adjustment ordered by the Sala Constitucional, the possibility of deciding this case has now arisen. Accordingly, this Chamber proceeds to issue the final decision, as set forth below.
II.Proven facts: For the proper resolution of this matter, the following relevant facts useful in deciding this case are deemed proven:
III.Grounds for appeal. In summary, without disregarding the extensive statement of grounds submitted by the appellant, the appeal alleges that the Mayor exceeded his authority because the land-use certificate was not challenged; only official letter No. DUUPT-V-03-084-2016 of March 9, 2016, from the Unidad de Planificación Territorial was challenged. The appellant considers that the challenged act does not address the relief requested, because its claim sought removal of the 500 m2 construction limit imposed by that official letter. However, through his decision, the Mayor not only failed to address the requested relief but also rendered the land-use certificate devoid of substance, leaving unanswered the appellant’s request to construct a grocery store with premises measuring 1000 m2.
IV.Merits. The appellant requested approval of a land use for its property for operation as a mini-supermarket. The request was granted through Land-Use Certificate No. PPT-CUS-H-184-2015 of May 5, 2015, which informed it that, because the property was located in a Low-Density Residential Zone, the use was subject to certain limitations, primarily relating to construction, including—of relevance to this case—a requirement that lot coverage not exceed 70% of the land area. This act is valid and effective, and no ruling has annulled it; it therefore remains fully in force. In the operative portion of Resolution No. AM-125-16 of November 14, 2016, the Mayor erroneously ruled on a nonexistent appeal against that land-use certificate. Although that administrative act neither amended the certificate nor deprived it of substance, as the appellant contends, this portion of the challenged act must be annulled because the Mayor was not called upon to review the contents of that land-use certificate on appeal pursuant to a vertical administrative remedy (recurso vertical). It should be noted, however, that the certificate is limited to the appellant’s original claim, which sought to construct a mini-supermarket or grocery store.
V.In this case, confusion arose from the pleading (libelo) dated 29 de febrero del 2016, which the appellant filed several months after the land-use certificate (certificado de uso de suelo) had been issued. Based on its content, she described a change in her plans and reconsidered the possibility of subdividing (segregar) from the same property a 2000 m2 lot on which she now seeks to build not a grocery store, but a supermarket, taking advantage of the 70% coverage allowed under the conditional land use (uso de suelo condicional) issued, that is, 1400m2. Her application was addressed through official letter No. DUUPT-V-03-084-2016 of 9 de marzo del 2016, in which the Territorial Planning Unit informed her that the Permitted or Conditional uses under the property’s zoning (zonificación) do not include supermarket operations, and reduced the buildable area (área constructiva) to 500m2 by applying, on a supplementary basis to the Desamparados Land-Use Plan (Plan de Ordenamiento Territorial de Desamparados), the Regulations to the Law on the Regulation and Sale of Beverages Containing Alcohol.
It was this act that gave rise to the present series of appeals (escalerilla recursiva). The Mayor heard the corresponding appeal (alzada), since the appellant considered the outcome adverse, through the decision whose lawfulness is now under review. In this regard, it must be stated that the entire case, based on the scenario presented by the appellant, amounts to no more than consideration of a hypothetical situation that does not exist, because there is no subdivided property and, still less, has the proposed construction project been submitted. When responding to the appellant’s inquiry through official letter DUUPT-V-03-084-2016 of 9 de marzo del 2016, the Territorial Planning Unit addressed an aspiration of the appellant that had not been specifically materialized and that cannot produce effects when it concerns a property that has not been subdivided. The Administration’s activity must be directed toward providing concrete answers and solutions through the issuance of effective administrative acts (actos administrativos) that are, above all, enforceable.
In this case, the entire analysis is based on assumptions, and it is unreasonable for the Administration to issue a decision on that same basis. The only established fact available to the parties, both the Municipal Administration and the appellant, is the existence of property No. 358298, registered survey plan (plano catastrado) 1795432-2015, with the area indicated in the Property Registry. It is solely on that factual basis that any land-use determination and the other restrictions encumbering the real property may be decided. It must further be stated that neither the Administration, and still less this Chamber, may rule on restrictions affecting a property that does not exist and has not legally come into existence, because the subdivision (segregación) has not even been completed, there are no plans, and it has no real-property folio registration (matrícula de folio real). Hypothetical cases cannot bind either the Administration or the person subject to its authority, based on misleading information arising from an idea that remains merely an intention.
The Administration must act responsibly in all its proceedings and must not commit itself to criteria or positions when presented with mere hypothetical facts. To date, the appellant has not even applied, through the procedures established for that purpose, for a supermarket land-use certificate, notwithstanding her assertion that a minimarket constitutes the same activity. After thorough and serious deliberation, this Court concludes that this entire case is premature, insofar as the party has not even completed the subdivision of the property. Once the new property legally comes into existence, she will be required to apply for a land-use certificate for it, so that the actual public-order restrictions (limitaciones de orden público) encumbering it may be determined. The existing land-use certificate applies only to what may currently be called the parent property (finca madre) and therefore does not extend to properties subdivided from it.
Indeed, Article 28 of the Desamparados Land-Use Plan itself provides that an application for a land-use certificate must include a copy of the registered survey plan for the property submitted for zoning assessment, demonstrating that the real property must materially exist. Unfortunately, in this situation, in which the party so clearly presented before this Chamber a claim seeking a determination of the buildable area of a nonexistent lot, the claim is itself impossible to adjudicate. This position is supported by ordinal 35.5, point 9 of the Code of Civil Procedure, which applies on a supplementary basis and governs an inadmissible claim (demanda improponible), under which a claim must be dismissed where there is “the absence of a material or essential prerequisite of the claim.” Under these circumstances, no ruling may be issued on the remainder of the appeal filed, because the actions taken by the local authorities have no effect on the appellant’s legal sphere.
VI.Because the proceedings before this body were conducted electronically, the parties may obtain a complete copy containing both the administrative record (expediente administrativo) forwarded by the Municipal Corporation and all documents comprising this appeal, for which purpose they must provide an electronic storage device (USB flash drive or compact disc). Likewise, if any physical or electronic documentation (plans, photographs, reports, etc.) was submitted and remains in the custody of the Court Office, the person who submitted it may retrieve it within 30 business days, pursuant to Article 12 of the Regulations on Electronic Court Records before the Judiciary, approved by the Full Court at session n.° 27-11 of 22 de agosto del 2011, Article XXVI, and published in the Judicial Bulletin n.° 19 of 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary at session n.° 43-12 held on 3 de mayo del 2012, Article LXXXI.

The appeal is granted in part. The portion of decision No. AM-125-16 of 14 de noviembre del 2016 issued by the Mayor of Desamparados concerning Land-Use Certificate PPT-CUS-H-184-2015 of 5 de mayo del 2015 is vacated; that certificate remains final. No ruling is issued as to the remainder because the actions taken produce no legal effect for the reasons stated supra.

PROCESO: JERARQUIA IMPROPIA (Municipal) Apelante: INMOBILIARIA TIRRAZÚ DEL SUR S.A.
Recurrido: MUNICIPALIDAD DE DESAMPARADOS No. 55-2022 TRIBUNAL CONTENCIOSO ADMINISTRATIVO. SECCIÓN TERCERA, ANEXO A DEL II CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las once horas del veinticuatro de febrero de dos mil veintidós.
Recurso de apelación interpuesto por Inmobiliaria Tirrazú del Sur S.A., cédula jurídica CED85091, representada por su apoderada generalísima sin límite de suma, la señora Marta Eugenia Muñoz Delgado, cédula de identidad CED85092, contra la resolución No. AM-125-16 del 14 de noviembre del 2016 del Alcalde de Desamparados.
Redacta la jueza Solano Ulloa; y,
Considerando:
I.De previo. El acto apelado del Alcalde de Desamparados, hizo aplicación de las disposiciones contenidas en el Plan GAM 2013-2030, contenido en Decreto Ejecutivo No. 38334-PLAN-MINAE-MIVAH-MOPT-SMAG, respecto de las "Centralidades Urbanas, Densas e Integrales", lo cual cuestiona la sociedad recurrente dentro de su libelo de agravios. La aplicación de dichas normas fue suspendida en su totalidad por la Sala Constitucional, según lo dispuso en auto de las 15:20 horas del 28 de enero del 2015, dentro de la acción de inconstitucionalidad No. 14-019525-0007-CO, razón por la cual esta causa fue suspendida por esta Cámara en auto de las 9:20 horas del 18 de julio del 2018. Mediante consulta realizada en la página web Nexus, se informa que la acción fue resuelta en sentencia de la Sala Constitucional N° 023743 del 9 de diciembre de 2020, cuya parte dispositiva fue publicada en el Boletín Judicial No. 34, 35 y 36 del 18, 19 y 22 de febrero del 2021 pero su texto íntegro a la fecha no ha sido publicado. Posteriormente mediante resolución de la Sala Constitucional N° 011958 del 26 de mayo de 2021, se adicionó la parte dispositiva de la sentencia 2020-023743, para que en definitiva se lea de la siguiente manera:
" Por unanimidad, se declara CON LUGAR la acción. En consecuencia, se declara inconstitucional el Decreto Ejecutivo Nº 38334-PLAN-MINAE-MIVAH-MOPT-S-MOPT del 10 de marzo de 2014, por violación al principio de inderogabilidad singular de las normas y al derecho al ambiente sano y ecológicamente equilibrado, resguardado en el artículo 50 de la Constitución Política. Esta sentencia tiene efectos declarativos y retroactivos a la fecha de vigencia de la normativa anulada, sin perjuicio de los derechos adquiridos de buena fe. Sin embargo, de conformidad con lo dispuesto por el artículo 91 de la Ley de la Jurisdicción Constitucional, se dimensionan los efectos de la sentencia para evitar serias dislocaciones al orden y la seguridad, y se mantiene la vigencia del Decreto Ejecutivo Nº 38334-PLAN-MINAE-MIVAH-MOPT-S-MOPT del 10 de marzo de 2014 normativa declarada inconstitucional, hasta por un plazo de treinta y seis meses a partir de la publicación íntegra de la sentencia en el diario oficial La Gaceta, para que se emita una nueva normativa que contenga un proceso de evaluación ambiental estratégica u otro estudio técnico que incorpore adecuadamente la variable ambiental al plan objeto de esta acción, ante la Secretaría Técnica Nacional Ambiental.
De no producirse lo anterior, en ese plazo, se tendrá por expulsado -definitivamente- del ordenamiento jurídico el Decreto Ejecutivo N° 38334-PLAN-MINAE-MIVAH-MOPT-S-MAG del 10 de marzo de 2014. Por la forma en que se resuelve, se omite pronunciamiento sobre el resto de los argumentos de fondo esgrimidos en esta acción. El Magistrado Cruz Castro da razones adicionales. El magistrado Castillo Víquez pone nota. El Magistrado Rueda Leal y la Magistrada Hernández López consigan notas separadas. La Magistrada Garro Vargas salva el voto respecto del dimensionamiento de los efectos de esta sentencia y de conformidad el artículo 91 de la Ley de la Jurisdicción Constitucional, indica que el Poder Ejecutivo deberá proceder a someter el plan previsto en el mencionado decreto al proceso de evaluación ambiental estratégica u otro estudio que incorpore la variable ambiental ante la Secretaria Técnica Nacional Ambiental, la que deberá dictar una resolución que corresponda.
Todo anterior deberá estar concluido dentro del plazo máximo de treinta y seis meses contado a partir de la publicación integra de esta sentencia en el Boletín Judicial. La ejecución de este pronunciamiento se realizará ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia del Código Procesal Contencioso Administrativo. Durante el plazo otorgado el decreto se mantendrá vigente. En caso de no cumplirse con la obligación aquí impuesta dentro del plazo indicado, la declaración de nulidad surtirá plenos efectos jurídicos. Remítasele copia de la sentencia al Área de Ejecución del Tribunal de lo Contencioso Administrativo y Civil de Hacienda para que inicie los procedimientos de ejecución de este fallo. Además, la Magistrada Garro Vargas consigna nota. Comuníquese este pronunciamiento a los Poderes Legislativo, Ejecutivo y Judicial, así como a las instituciones apersonas al expediente. Reséñese este pronunciamiento en el diario oficial La Gaceta y publíquese íntegramente en el Boletín Judicial. Notifíquese”.
Como se aprecia, las razones de inconstitucionalidad aún no han sido puestas en conocimiento de terceros ante la falta de publicación. Sin embargo, teniéndose claro que la inconstitucionalidad decretada del Reglamento entrará a regir en fecha futura conforme al dimensionamiento dispuesto por la Sala Constitucional, es claro que ya se ha abierto la posibilidad de resolver la presente causa. En virtud de lo anterior, esta Cámara procede con el dictado de la resolución final, tal como de seguido se procede.
II.Hechos probados: Para una correcta resolución del presente asunto, se tiene por hechos probados de relevancia, útiles para resolver esta causa, los siguientes:

En síntesis, sin obviar el extenso libelo de agravios presentado por la parte apelante, el recurso reclama que el Alcalde se extralimitó en sus funciones, toda vez que el certificado de uso de suelo no fue impugnado, sino solamente el oficio No. DUUPT-V-03-084-2016 del 9 de marzo del 2016 de la Unidad de Planificación Territorial. Considera que el acto apelado no corresponde con lo solicitado, pues su pretensión era eliminar el límite de 500 m2 de construcción que le había impuesto dicho oficio. Sin embargo, con lo resuelto, el Alcalde no solo no atendió lo solicitado, sino que además dejó sin contenido el certificado de uso de suelo, quedando sin respuesta su petición tendente a construir un abastecedor con un local de 1000 m2.
IV.Sobre el fondo. La parte apelante solicitó un uso de suelo para la finca de su propiedad, para uso de minisúper, el cual fue resuelto favorablemente mediante el certificado de uso de suelo No. PPT-CUS-H-184-2015 del 5 de mayo del 2015, con el cual se le informó que, por ubicarse en Zona Residencial de Baja Densidad, el uso era condicionado a ciertas limitaciones principalmente de índole constructivo, entre ellas y de interés para el caso, que la cobertura no fuera superior al 70% de la superficie del terreno. Este acto es válido, eficaz y no ha habido pronunciamiento alguno que lo anule, de modo que tiene plena vigencia. En la parte dispositiva de la resolución No. AM-125-16 del 14 de noviembre del 2016, el Alcalde se pronunció erradamente sobre un recurso de apelación inexistente en contra de dicho certificado de uso de suelo. Si bien dicho acto administrativo no lo modificó ni le vació su contenido, como estima el recurrente, debe anularse este pronunciamiento del acto venido en alzada, puesto que el Alcalde no se dio a la tarea de revisar en apelación, producto de un recurso vertical, el contenido de ese certificado de uso de suelo. Ahora bien, ha de advertirse que el mismo se limita a la pretensión original de la apelante, tendiente a construir un minisúper o abastecedor.
V.En esta causa se produjo una confusión a partir del libelo fechado 29 de febrero del 2016 que presentó la recurrente varios meses después de expedido el certificado de uso de suelo, pues basándose en el contenido de aquel, expuso un cambio en sus planes y replanteó la posibilidad de segregar de la misma finca, un lote de 2000 m2, en el cual aspira a construir, ya no un abastecedor, sino un supermercado, aprovechando la cobertura del 70% del uso de suelo condicional expedido, o sea, 1400m2. Su gestión fue atendida mediante oficio No. DUUPT-V-03-084-2016 del 9 de marzo del 2016, en el que la Unidad de Planificación Territorial le informó que los usos Conforme o Condicional de la zonificación de la finca no prevé la actividad de supermercado, y le redujo el área constructiva a 500m2, aplicando supletoriamente al Plan de Ordenamiento Territorial, el Reglamento a la Ley de Regulación y Comercialización de Bebidas con contenido Alcohólico.
Es a partir de este acto que se genera la presente escalerilla recursiva. El Alcalde conoció la respectiva alzada dado que el resultado lo estimó lesivo la parte apelante, mediante la resolución cuya legalidad se somete a revisión en esta ocasión. Sobre este particular, debe indicarse que toda la causa, a partir del caso planteado por la recurrente, no es más que la atención de un supuesto hipotético que no existe, pues no existe finca segregada y menos aún ha sido planteado el supuesto proyecto constructivo. Desde que se dio respuesta a la inquietud de la apelante, en oficio DUUPT-V-03-084-2016 del 9 de marzo del 2016, la Unidad de Planificación Territorial atendió una aspiración no materializada concreta de la parte recurrente, que no puede generar efectos si se trata de una finca que no ha sido segregada. La actividad de la administración debe estar dirigida a dar respuestas y soluciones concretas, mediante la expedición de actos administrativos eficaces pero, sobre todo, ejecutables.
En esta causa todo el estudio parte de una base de supuestos y no es razonable que la Administración resuelva de la misma manera. La única base cierta con la que cuentan las partes, tanto la Administración Municipal como la apelante, es la existencia de la finca No. 358298, plano catastrado 1795432-2015, con la cabida que registralmente indica. Sobre esa única base real, es que se puede resolver cualquier uso de suelo y las demás limitaciones que pesen sobre el inmueble. Por demás debe indicarse que ni la Administración y, menos aún esta Cámara, puede resolver respecto de limitaciones de una finca que no existe, que no ha nacido jurídicamente pues la segregación ni siquiera se ha concretado, no existen planos ni tiene matrícula de folio real. Casos hipotéticos no pueden vincular ni a la Administración ni al administrado, con datos engañosos producto de una ideación que permanece aún en intenciones.
La Administración debe ser responsable en todas sus actuaciones, no debiendo comprometer sus criterios y posiciones cuando le planteen meros supuestos de hecho. La parte apelante a la fecha ni siquiera ha solicitado, por las vías establecidas al efecto, un certificado de uso de suelo para supermercado, aun y cuando pretenda argumentar que la actividad de minisúper es la misma. Este Tribunal, luego de deliberar con profundidad y seriedad, llega a la conclusión que toda la presente causa es prematura, en el tanto la parte no ha concretado siquiera la segregación de la finca. Cuando ésta nazca jurídicamente, estará en el deber de peticionar el certificado de uso de suelo para la nueva finca, a efecto de conocer las verdaderas limitaciones de orden público que pesen sobre ella. El actual certificado de uso de suelo existente, es únicamente para lo que hoy se podría denominar la finca madre, de modo que no alcanza los fundos que se segreguen de ésta.
Inclusive, véase que el mismo artículo 28 del Plan de Ordenamiento Territorial de Desamparados dispone que, para peticionar un certificado de uso de suelo, es necesario presentar copia del plano catastrado de la finca sometida a valoración de zonificación, con lo cual se evidencia que debe existir materialmente el inmueble. Lamentablemente en este supuesto, donde la pretensión de la parte ha sido tan claramente plasmada ante esta Cámara tendiente a que se le resolviera el área constructiva de un lote inexistente, es en sí misma, también una pretensión imposible de atender. Esta tesis se sustenta en el ordinal 35.5, punto 9 del Código Procesal Civil, aplicable supletoriamente, que regula la demanda improponible, según el cual debe ser rechazada aquella demanda ante “la falta de un presupuesto material o esencial de la pretensión”. En tales condiciones, no se puede hacer pronunciamiento respecto del resto del recurso de apelación interpuesto, por cuanto lo resuelto por las autoridades locales carece de efectos sobre la esfera jurídica de la parte apelante.
VI.Al haberse sustanciado esta sede en forma electrónica, queda a disposición de las partes obtener una copia integral que contiene tanto el expediente administrativo remitido por la Corporación Municipal así como la totalidad de las piezas que conforman la presente alzada, para lo cual deberá aportar el dispositivo electrónico de almacenamiento (llave maya o disco compacto). Asimismo, en caso que hubiere ingresado documentación física o electrónica (planos, fotografías, informes, etc) que permanezca aún en custodia el Despacho, podrá retirarla quien la aportó en un plazo de 30 días hábiles, de conformidad con lo dispuesto en el artículo 12 del Reglamento sobre Expediente Electrónico ante el Poder Judicial, aprobado por la Corte Plena en sesión n.° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial n.° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión n.° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto
Se declara parcialmente con lugar el recurso de apelación. Se anula de la resolución No. AM-125-16 del 14 de noviembre del 2016, del Alcalde de Desamparados, el pronunciamiento relacionado con el Certificado de uso de suelo PPT-CUS-H-184-2015 del 5 de mayo del 2015, el cual permanece firme. En cuanto a lo demás, se omite pronunciamiento dado que lo actuado no genera ningún efecto jurídico por las razones indicadas supra.
