BACKGROUND:
The judgment was drafted by Judge Mejías Rodríguez, with Judges Nombre30488 and Gómez Chacón voting in favor.
CONSIDERING:
The following are relevant to the resolution of this matter:
This entails, among other things, the establishment and declaration of national parks, biological reserves, wildlife refuges, forest reserves, and protected zones, as well as ensuring their environmental defense and preservation, for as long as the aforementioned administrative legal regime is not repealed. As such, it is an expression of the power and will of the legislative majority, delegated by the electorate to the Legislative Assembly through suffrage. It is a different matter that the individual interests of Mr. Nombre18250 and Nombre18250, Nombre18250, or those of their attorney, dissent in the present proceeding from that worldview and from that legally enshrined public interest. As he acknowledges, this constitutes his position, which is respected but not shared. The relief sought in the public-interest invalidation proceeding (proceso de lesividad) is the annulment of cadastral plans and Registry entries.
Therefore, contrary to his argument, it is not a public-interest invalidation proceeding based on reasons of expediency or convenience. Nor does it involve a unilateral revocation by the Administration on its own initiative in administrative proceedings. Consequently, the compensation provision presupposed by that mechanism is likewise inapplicable. The issue of compensation depends on the outcome of the consolidated proceedings—the ordinary proceeding and the public-interest invalidation proceeding. It therefore cannot be decided in advance within the incidental proceedings concerning interim relief (medidas cautelares), much less with final and definitive effect. Furthermore, and without prejudice to the foregoing, it should be noted that the possibility of requiring countersecurity (contracautela) was not even raised for consideration. Accordingly, the allegation of a violation resulting from the failure to apply the third paragraph of Article 37 of the Ley Orgánica del Ambiente—and not Article 36 of the Ley de Biodiversidad—is rejected.
That paragraph provides: “...Privately owned properties affected pursuant to this article because they are located within national parks, biological reserves, wildlife refuges, forest reserves, and protected zones shall become part of state protected areas only once they have been paid for or lawfully expropriated, unless they voluntarily submit to the Régimen Forestal. In the case of forest reserves, protected zones, and wildlife refuges, where payment or expropriation has not occurred, and pending such payment or expropriation, the areas shall be subject to an environmental land-use plan (plan de ordenamiento ambiental) that includes an environmental impact assessment (evaluación de impacto ambiental) and, subsequently, to a management, recovery, and resource-restoration plan.” (emphasis added. The preceding paragraph was amended in this manner by Article 72(c) of the Ley Forestal, N° 7575 of February 13, 1996, which was in turn amended by Article 114 of the Ley de Biodiversidad, N° 7788 of April 30, 1998).
As such, this issue—the procedural claim for compensation—must be decided on the merits in the judgment. In general, the appellant does not clarify whether the ordered precautionary measures (medidas precautorias) are appropriate, nor does he refute the urgency or necessity asserted by the State concerning the possible adverse and subsequent consequences that could arise if the requested interim relief is not granted. The remaining arguments, summarized as follows: that they are not squatters but good-faith purchasers of property located within the National Park; that one day Fundación Neotrópica claimed ownership of certain lands, drew a line, transferred them to the State, and thereby expanded Parque Nacional Tortuguero; that the Foundation assembled and donated what did not belong to it and that, because of that transfer, state officials now seek to discredit their good faith and the agricultural and silvicultural activities they carry out, as well as their registered property right; that they object that persons may enter their property, destroy houses and fences, release cattle to roam, burn farming implements, and destroy their assets as modest farmers; that they are now being dispossessed of their land without prior compensation despite holding title and possession; that the public-interest invalidation proceeding is a denial for denial’s sake of the right to which they obtained access, as well as of the right acquired through “rectification”; that it is untrue that annulment of the plan rectification would leave them in legal limbo; and that they are good-faith purchasers—relying on the public notice provided by the Registry—from the prior owner, who registered the property through possessory title proceedings (Información Posesoria), in good faith and publicly, after public bodies and entities had been heard and an on-site inspection had been conducted, and that their ownership has become vested because the limitation periods have already expired—are rejected as improper within these interim-relief proceedings, since they concern the merits of the principal proceeding or proceedings and must be determined in the judgment.” (Images 31 to 43 of the electronic case file). 6) At the public oral trial, testimony was received from Nombre30489, who stated that he has lived in the locality for 35 years, is a farmer, and knows the area.
He explained that the property at issue in the proceeding had belonged to him; that he sold it to Nombre18250 approximately 20 years ago; that it was a property registered with the Registry; that he built a house and a corral there; and that he had pastureland and hired workers on it, but at some point everything burned, although he does not remember exactly when. (Trial audio and video in SIGAO). 7) Subsequently, during the same oral-trial session, testimony was received from Nombre23689, who stated that he lives in the locality; that he has known the property for more than 20 years; that it was used for farming and livestock; that it had pastureland and fences on three lots; that the property had been cleared of undergrowth; and that it had a pump for drawing water, corrals, fruit trees, coconut palms, and a small house. He regularly visits the area; nothing that once existed remains today, and he explained that the property was last visited approximately four years ago. (Trial audio and video in SIGAO).
For purposes of resolving this dispute, the following are deemed unproven: 1) The exact date and details of the eviction (desalojo) carried out against the plaintiffs herein. (The record). 2) That the Limón Registry entries numbers Placa5291 and Placa5292 were closed or canceled as a result of the judicial proceedings conducted under case files Placa5293 and Placa5294. (The record). 3) Proof of judicial error in judgment 108-2016-II issued by the Second Section of the Administrative and Civil Court of the Treasury. (The record). 4) The existence of threats by Minae officials impairing the dignity of the plaintiffs. (The record).
In these proceedings, the plaintiffs seek compensation on the grounds that, in their view, they were unlawfully dispossessed of the use of the property to which they hold title. They state that the property had been devoted to an agroforestry system (sistema agroforestal), with part of it consisting of pastureland containing thirty hectares of improved pasture used for grazing livestock, duly enclosed with barbed-wire fencing and with properly cleared paths, all since its acquisition in 2001. They state that, pursuant to decree 27227 of 1998, the property became enclosed within the expansion of Parque Nacional Tortuguero. They indicate that appellate decision 108-2016-II, issued on appeal from the interim measures (medidas cautelares) ordered in case files 07-001253-0163-CA and 06-001333-0163-CA, affected the property owned by the plaintiffs because it ordered the removal of animals and persons; abstention from carrying out any activity thereon, including drainage, brush clearing, removal of, damage to, or destruction of plants, forest cover (cobertura forestal), shrub cover, or palm cover (any type of trees, shrubs, or palms); land-use change (cambio de uso del suelo); and construction, as well as the cutting of trees or extraction of timber from areas of Parque Nacional Tortuguero; and ordered that no forest harvesting (aprovechamiento forestal) be approved, that the implementation of any management plans (planes de manejo) then pending—if any—be suspended, that no decision be made to pay environmental services (servicios ambientales), and that Municipalidad de Pococí refrain from issuing construction permits until the proceedings were resolved.
They state that, in June 2017, MINAE officials threatened them, telling them that they had to remove the animals, that they could not remain on the property, and that the officials would burn the dwelling and corrals and destroy the fences. At the request of the Office of the Attorney General, through Attorney Fallas Cubero, the dispossession was carried out, “rendering it unusable as a sustainable resource and agricultural and livestock property, causing financial harm and driving Nombre18250 and their families into a state of imminent poverty as a result of the request and judicial decisions contrary to the legal system,” even though, pursuant to Articles 456 and 477 of the Civil Code, they are good-faith third-party purchasers; therefore, the declaration of adverse effect (lesividad) should not have affected them, particularly because the Registry entry had not been declared false or void, or to constitute usurpation of public-domain property.
They explain that such declaration was based not on grounds of nullity but on expediency, and therefore should not impair the plaintiffs’ individual rights (derechos subjetivos), and that, in any event, they were not compensated pursuant to Article 45 of the Constitution, the Expropriations Law, and Article 144 of the General Public Administration Law. They state that the absence of such compensation constitutes financial loss (daño patrimonial) resulting from the inability to exploit the commercial resource, valued at fifty million colones; six hundred thousand colones per month for the inability to use and lease the thirty hectares of pasture; and three hundred million colones for the value of the land. Furthermore, given the “threats by officials and now the dispossession, an anguishing situation of uncertainty has arisen, causing psychological and economic harm, since the families of the plaintiffs herein have lost their entire means of financial support, resulting in harm to their physical and mental health; I therefore quantify non-pecuniary damages (daño moral) at ten million colones for each plaintiff.” In other arguments, they note that “As may be observed, if this is an administrative act (acto administrativo) in the strict sense, it is clear that its modification or extinguishment occurs through revocation, as a means of extinguishing an administrative act for reasons of expediency, suitability, or discretionary merit, in the case of entirely valid and effective administrative acts, as well as through annulment of an act, which presupposes that the act was never valid or perfected and that any effects it may have produced are provisional.” They explain that, pursuant to Articles 142, 144, 171, 173, and 183 of the LGAP, this is a revocation and, as such, must entail compensation.
In their closing arguments, the plaintiffs state that the origin of this matter lies in the expansion of Parque Nacional Tortuguero, which caused the property to be included within the park. They assert that, at that time, Fundación Neotrópica purchased land in the area, prepared a general cadastral survey plan (plano catastral), and then transferred everything to the State for the park’s expansion. They categorically assert that the plaintiffs own a property recorded in the Registry and possess an accompanying right of possession (derecho de posesión), rejecting their characterization as unlawful occupants (precaristas). The property in question originated through possessory title proceedings (información posesoria), with all required procedures being followed: a registered cadastral plan, Minae, the Office of the Attorney General, and judicial valuation, with no objection whatsoever to the existence of the Registry entry, even during the validation period.
They explain that an error in one of the property’s coordinates was subsequently detected and corrected. The plaintiffs maintained possession at all times. Subsequently, the declaration of adverse effect gave rise to an issue of State liability for judicial acts (responsabilidad de Estado–Juez), generating compensable damages, which are the subject of these proceedings. Among the errors, they emphasize that ex officio proceedings were never conducted in lieu of the declaration of adverse effect, and that the plaintiffs were not notified of that declaration, thereby violating due process and the principles of legal security and certainty. The principal problem, however, is that the declaration of adverse effect was not accompanied by the corresponding compensation for either the individual right of ownership or the right of possession; instead, the plaintiffs herein were evicted in what they characterize as an unlawful dispossession, in contravention of Articles 141, 142, 143, 155, 175, and 183 of the General Public Administration Law, as well as Article 37 of the Environmental Law, because their individual rights were not respected. In their view, the declaration of adverse effect should have been accompanied by compensation for loss and damages (daños y perjuicios).
In its answer and closing arguments, the Office of the Attorney General states that, according to the evidence in the record, the plaintiffs acquired the property by public deed associated with registered cadastral plan L-655208-2000, which is located outside any protected area. They subsequently prepared two plans, one in 2004 and another in 2006, placing the properties within Parque Nacional Tortuguero, and those plans were later associated with the plaintiffs’ Registry entries. Thus, in 2007, an action seeking a declaration of adverse effect was filed to challenge the registered cadastral plans and the property’s Registry transactions (movimientos registrales); in turn, that case, 07-001253-0163-CA, was consolidated with 06-001333-0163-CA, and both were resolved by a final judgment in 2017. Interim measures were ordered in those proceedings and affirmed by appellate judgment 108-2016-II of Section II, which the plaintiffs regard as the cause of the dispossession.
The plaintiffs seek to reopen the issues litigated in those proceedings, which were rejected on appeal in cassation (recurso de casación), where they raised the same arguments at issue here (due process, the procedure for the declaration of adverse effect, and the claim for loss and damages). Thus, at the preliminary hearing in this case on February 17, 2021, the plaintiffs limited the act giving rise to the alleged harm solely to the aforementioned decision of Section II, relying on purported State liability for judicial acts to recover damages relating to the Registry entries and subjective non-pecuniary harm (daño moral subjetivo). The State clarifies that the plaintiffs remain the registered owners of their respective Registry entries, as shown by images 405-408 of the court record. Accordingly, when the claim is confined to the aforementioned judicial decision, the plaintiffs fail to establish that it was erroneous, arbitrary, or contrary to law.
It notes that all of the plaintiffs’ arguments, particularly those presented in their closing arguments, concern not the judicial act at issue in these proceedings but the aforementioned declaration of adverse effect, which is distinct. It considers the modification of the interim measures consistent with the judgment on the merits issued six months later, namely decision 1054-2017 at 15:00 on June 16, 2017, which upheld the action seeking a declaration of adverse effect and annulled the aforementioned plans and the Registry transactions associated with them; as well as ruling 61-2017-II of the Second Section acting as an appellate court, which was subsequently affirmed by ruling 712-2018 of the First Chamber of the Supreme Court of Justice at 9:20 a.m. on August 16, 2018. Consequently, no error in applying the legal system has been established; rather, this is merely the plaintiffs’ disagreement with a decision having the effect of substantive res judicata (cosa juzgada material), and it emphasizes that their claims were already heard and rejected in judgment 1054-2017.
As a consequence of the ruling in those proceedings, it is clear that the plaintiffs’ exercise of possession—which, in reality, took place within the Área Protegida—renders their occupation unlawful, and no impairment of an individual right has been established. The basis of the plaintiffs’ claim, namely their alleged possession of those physical areas, is fundamentally unlawful because the land is public property pursuant to Articles 13 and 14 of the Ley Forestal; it is therefore erroneous to speak of dispossession from their property, particularly considering that they remain the holders of the respective Registry entries, and their claims consequently lack legal basis. It explains that witness Nombre23689 was one of the unlawful occupants evicted, as was witness Nombre30489, and that both sought relief through amparo proceedings (recursos de amparo), which were denied. In any event, because there is no State liability for judicial acts, the testimony of both witnesses is irrelevant.
Finally, there is no causal connection between decision 108-2016-II, which is the subject of these proceedings, and the alleged dispossession of June 1, 2017. It reiterates its request that the complaint be dismissed and that costs and interest be awarded.
This Court has stated on numerous occasions that State liability (responsabilidad del Estado) for judicial actions (actuaciones jurisdiccionales) has been the subject of study and controversy over time, because, on the one hand, it has been argued that a statute must be enacted to establish its liability regime (régimen de responsabilidad), as provided in Article 154 of the Constitution (Carta Magna), while others contend that compensation for damages caused by the exercise of the judicial function (función jurisdiccional) may be grounded in Articles 9 and 41 of the Constitution. The latter position has been accepted by both the Constitutional Chamber (Sala Constitucional) and the First Chamber (Sala Primera), both of the Supreme Court of Justice (Corte Suprema de Justicia). Of particular interest is judgment 654-F-S1-2008 of the First Chamber, de las diez horas cuarenta y cinco minutos del veintiséis de setiembre de dos mil ocho, which stated verbatim: “Within the dynamics inherent in a Social and Democratic State governed by the rule of law (Estado Social y Democrático de Derecho) (such as that maintained in Costa Rica)—the first precept of the Constitution—the relationships arising between persons and public authorities are subject to review for legality (control de legalidad) and to the liability arising from State conduct, provided that such conduct has caused harm that the victim has no legal duty to bear (underlying unlawfulness (antijuridicidad de base)).
The subjection of the State to the law and the regime of liability for damages constitute some of the great achievements of this model of democratic government. This social vision of the rule of law is precisely the result of the combination of the inviolable principles that permeate it and comprise a set of guarantees, namely: legality, universal review of State conduct, and a system of public liability (responsabilidad pública). From this perspective, public authorities possess powers conferred upon them for the fulfillment of a purpose (the satisfaction of general interests), so as to permit the realization of the values of justice, equality, and protection against financial loss (indemnidad patrimonial) imposed by the legal system. If the law empowers the State in its various functions (executive, legislative, and judicial), the logical and natural consequence is the imposition of a liability system that allows reparation for the harmful effects that its actions may cause within the legal sphere of persons (which includes the protection of individual rights (derechos subjetivos) and legitimate interests (intereses legítimos)).
These principles have been developed more extensively in the area of Public Administration liability, through an evolution whose significance has already been demonstrated in the case law of this Chamber, including, among many others, judgment no. 584 de las 10 horas 40 minutos del 11 de agosto del 2005. V.—The foregoing is supported by the constitutional legal framework itself. The Principle of Public Liability (Principio de Responsabilidad Pública) is expressly recognized in Article 9 of the Constitution, which provides: ‘The Government of the Republic is popular, representative, participatory, alternating, and accountable. It is exercised by the People and by three separate and mutually independent Branches: the Legislative, the Executive, and the Judicial....’ It is likewise developed and supplemented by the principle of legality (principio de legalidad) (Article 11), equitable distribution of public burdens (equidad en la distribución de las cargas públicas) (Articles 18 and 33), protection of legal situations and vested rights (tutela de las situaciones jurídicas y derechos consolidados) (Article 34), full compensation for harm (reparación integral del daño) (Article 41), protection against financial loss (Article 45), effective judicial protection (tutela judicial efectiva) (Article 49), the maxim of social solidarity (máxima de solidaridad social) (Article 74 of the Constitution), liability attaching to the office of the President (Article 148 ibidem), liability of the Judicial Branch (Articles 154 and 166 ibidem), and liability of autonomous institutions (Article 188).
These provisions constitute the foundations of that system, which requires monetary compensation for pecuniary or non-pecuniary injuries (lesiones patrimoniales o extrapatrimoniales) resulting from public acts or omissions. In the case of liability for actions of the Judicial Branch, the basis thereof has been developed by the Constitutional Chamber, whose judgment no. 5981 de las 15 horas 41 minutos del 7 de noviembre de 1995 stated, insofar as relevant: ‘V. STRICT LIABILITY OF THE JUDICIAL BRANCH (RESPONSABILIDAD OBJETIVA DEL PODER JUDICIAL). PRINCIPLES. (…) State liability arising from the exercise of the judicial function must be governed in accordance with the provisions of the Political Constitution itself and the law, as prescribed by Article 154 of the Constitution (…): “The Judicial Branch is subject only to the Constitution and the law, and the decisions it issues in matters within its jurisdiction impose upon it no liabilities other than those expressly established by legislative provisions.” Two basic conclusions follow from this: 1.) First, the direct liability of the State in cases of judicial error (error judicial) and abnormal operation of the administration of justice (funcionamiento anormal de la administración de justicia) constitutes a constitutional principle.
That liability arises specifically from Article 9 of the Constitution, (…) in relation to Articles 11, 33, 41, and 154 thereof, and is consistent with the principles of the Social State governed by the rule of law, specifically the prohibition against arbitrariness by public authorities, legal certainty, and the equality of all citizens before the law. This liability is justified by the fact that the adjudicative function is the manifestation of a Branch of government, one of the State’s three Branches, which entails its status as a public service and as an organization of material and human resources intended to satisfy society’s demand for justice. […] By virtue of Articles 9 and 153 of the Constitution, transcribed above, and in accordance with the general principle that “any person who causes harm must repair it,” the Judicial Branch cannot be exempted from liability for “judicial error” in the exercise of the judicial function.
It should be noted that this strict liability of the State supplements the civil, criminal, and disciplinary liability to which judges are subject, because those forms of liability are insufficient to adequately safeguard the interests of litigants (justiciables). The difficulties involved in enforcing them turn a potential claim into a veritable obstacle course and, in most cases, leave unprotected those situations in which malice or negligence on the part of the judge cannot be established. Liability must arise from intentional or negligent conduct by the judicial body, whether or not constituting a criminal offense (fault-based liability (responsabilidad por falta)).’ On this subject, reference may also be made to resolution no. 5207-2004 of that same Chamber, de las 14 horas y 55 minutos del 18 de mayo del 2004.” (Emphasis not in the original). An important distinction must be drawn with respect to the liability of Public Administrations because, although the two may share certain general features—such as the type of compensable harm, defenses to liability (eximentes de responsabilidad), and the requirement of actual and individually ascertainable harm—they proceed from different statutory premises.
The objective regime applicable to the Administration was specifically developed by the LGAP and cannot be treated as wholly equivalent to that of the State as adjudicator because, as just noted, the latter rests on judicial error, while the former rests on the obligation of Public Administrations to answer for all their lawful and unlawful actions, as well as for their normal or abnormal operation. In that setting, as previously stated, the adjudicator must determine how the judicial decision that may have given rise to liability was issued, without reviewing the actions of the judges, because this proceeding is not an appellate review thereof but instead addresses solely the issue of State liability, in order to determine whether such liability exists and, where appropriate, to establish the existence and quantify the amount of the damages.
LIMITATION OF THE SUBJECT MATTER OF THE PROCEEDING. The party-disposition principle (principio dispositivo), together with the pro-actione principle (principio pro actione), indicates that the action, embodied in the statement of the party who becomes the plaintiff, is limited or confined by that party’s intent as expressed through the formulation of the claims for relief (pretensiones), which constitute the requests on which the judge must rule. Consequently, neither the other parties nor the judge may alter that party’s requested relief (petitorias), which becomes the core of the action and is supplemented by the factual narrative supporting those requests (facts) and the corresponding evidence establishing the foregoing, all combined with the statement of reasons that, in the party’s view, justify the judge ruling in its favor (legal grounds (fundamentos de derecho)). Taken together, all these elements comprise what is commonly known as the theory of the case (teoría del caso) presented in the complaint.
Thus, the other parties—whether defendants, third parties, supporting intervenors (coadyuvantes), or, in general, any other procedurally authorized person—may frame the disputed issues, which, it bears repeating, originate in the action brought by the party filing the complaint, thereby avoiding irrelevant or immaterial discussions outside the scope of the dispute (extra litis) that would distract from the subject matter in controversy. In the case at hand, specifically at the preliminary hearing, the plaintiff limited its claims solely to judicial decision 108-2016-II of the Second Section of the Administrative and Civil Court of the Treasury (Sección Segunda del Tribunal Contencioso Administrativo y Civil de Hacienda), de las catorce con veinte minutos del veintiuno de diciembre de dos mil dieciséis, which it identifies as the cause of the harm under the theory of State-as-adjudicator liability and for which it seeks the compensation embodied in its claims.
Accordingly, the examination of the merits will determine whether the constituent elements of strict liability exist to support those claims, taking into account that the specifically identified decision affirmed an interim measure (medida cautelar) issued at the trial-court level by the Administrative Court (Juzgado Contencioso Administrativo). Therefore, it must be understood as an interlocutory measure (medida intraprocesal), with its effects limited to the period between the issuance of the appellate judgment that is the subject of this proceeding and the issuance of the judgment on the merits, because the latter supersedes the provisional effects of the interim measure and replaces them with a determination of the underlying legal situation upon issuance of the corresponding judgment; in other words, its effect was temporally limited. Furthermore, as a consequence of the same reasoning, the rulings at first instance, on appeal, or in cassation (casación) in the principal case files of proceedings 06-001333-0163-CA and 07-001253-0163-CA are not the subject of this proceeding, because they fall outside the subject matter of the dispute, even though, in the arguments presented in the complaint, reply, and closing submissions, the plaintiff sought to challenge the rulings concerning the actions to declare harmfulness to the public interest (lesividades) in those proceedings; those arguments are therefore devoid of utility because they are not linked to any procedural claim.
It must be recalled that, under the criterion for attributing strict liability (responsabilidad objetiva) to the Administration, a causal link must be identified among the responsible agent (the Administration), the challenged conduct, the type of harm, the specific harmful result, and its connection to the person suffering it; each of these elements must be supported by the necessary proof of causation, and the harm must meet the applicable requirements, namely: the absence of a duty to bear the harm, or the unlawful basis of the conduct; the certainty and ascertainability of the harm; the aforementioned causation; and the present existence of the harm. As explained in the preceding recital (considerando), the proceeding confines the challenged conduct to an appellate judicial ruling, under the criterion for attributing State-as-Judge liability. After distilling the plaintiffs’ arguments, submitted through their counsel, we find that the subject matter of the analysis must focus on the effects of ruling 108-2016-II and, because it concerns interim-relief matters (materia cautelar), the period during which that ruling remained effective, with the final judgment on the merits in proceedings 06-001333-0163-CA and 07-001253-0163-CA serving as the endpoint.
As grounds for challenging the decision, counsel asserts that such action gave rise to an unjustified dispossession and an impairment of the parties’ individual rights (derechos subjetivos), because they hold a property registration (matrícula inmobiliaria) from which they derive a legitimate right of possession for the exploitation, use, and enjoyment of the strip of land from which they were dispossessed without prior compensation, thereby causing the damages they seek to recover in this action. The Court’s finding: The plaintiffs’ theory does not satisfy the elements necessary to establish the State-as-Judge liability they claim, for the reasons explained below. First, the fundamental component of the liability regime that plaintiffs’ counsel seeks to invoke rests on proving the existence of an error or defect in a judicial act, which, in the best-case scenario, must be done in the same proceeding in which the act in question originated or arose; the possibility of such determinations elsewhere is exceptional, as in the case of judicial misconduct (prevaricato) in criminal matters.
Thus, if the competent authority were to establish, through the appropriate mechanisms, that the judicial conduct was improper, this would provide grounds for an action such as the one sought here. Indeed, the nature of the ruling at issue in this proceeding reveals a mistaken understanding on the part of the plaintiffs, because the conduct they attribute to that ruling—namely, the interim decision to halt the activity and evict both plaintiffs from the area they had previously occupied—did not arise from ruling 108-2016-II, but from the trial-level rulings (resoluciones de instancia) 1335-2013 and 1336-2013 (proven facts 3 and 4 of this judgment). Accordingly, limiting ourselves to the appellate role performed by Section II of the Administrative Litigation Court (Tribunal Contencioso Administrativo), it had four possible courses of action when reviewing a matter on appeal: dismissal as inadmissible when the appeal was improper or untimely; reversal of the decision, either in whole or in part, directly deciding the appropriate outcome without remanding it to the court below (a quo); vacatur of the decision with remand; and, finally, affirmance of the decision, which is precisely what occurred in judgment 108-2016-II.
Therefore, the burden of proof (onus probandi) to establish impropriety in the exercise of the power to affirm, as embodied in the ruling at issue, rested with the plaintiffs, and they did not meet it in these proceedings. It should be noted that there is no evidence whatsoever that the judicial action was determined to be improper in any forum, whether the original forum in which the action was taken or another, nor were any elements submitted in this action aimed at proving this basic component necessary to establish the unlawfulness of the action. It must be recalled that this proceeding is not an appellate forum for reviewing other courts; rather, its task is to assess whether the effects of such rulings may constitute harmful actions giving rise to compensation. That requirement has not been met here. The State’s counsel is therefore correct in asserting that, at bottom, this matter concerns the plaintiffs’ disagreement with the decision issued in that other judicial proceeding, without proving such factors as disproportionality, irrationality, or, in general, any defect in the exercise of appellate jurisdiction by the appellate court (Ad Quem), whose task is to hear the vertical appellate remedy of appeal.
Second, the factual record demonstrates the existence of a judicial decision that complies with the parameters of legality governing the exercise of jurisdiction to review an interim measure (medida cautelar) through a vertical appeal. In this regard, the fact that the decision affirmed rulings 1335-2013 and 1336-2013, and that those rulings had depriving or detrimental effects on the plaintiffs’ interests, does not, by that fact alone, create a legally protectable situation, because the interim-relief framework permits preservative, modifying, or innovative measures, which may create an imbalance between the parties by benefiting one and potentially harming the other. That assessment is made by examining the components of an interim measure: risk in delay (peligro en la demora), appearance of a valid right (apariencia de buen derecho), instrumentality (instrumentalidad), and, above all, the balancing of the interests at stake.
In this case, the ruling under discussion sets out with extreme precision the analysis of each of these components, which was conducted based on the evidence in those proceedings, and the plaintiffs have not established in this proceeding any pathological exercise of judicial authority. Third, it must be borne in mind that the plaintiffs erred in their assessment, because the decision in ruling 108-2016-II did not directly affect their right of ownership, but rather their holding (tenencia)—the identification of that right with a specific physical area. In particular, as established by proven fact 1 of this judgment, the plaintiffs remain the holders of undivided rights 001 and 002 under registration Placa5295 of the Province of Limón. Accordingly, plaintiffs’ counsel’s assertion that the claimants’ “individual rights” were impaired does not specify exactly what type of injury is alleged or which right or rights are being referenced; instead, it uses the phrase as an indeterminate generic expression.
The first claim is therefore plainly inadmissible, because the appellate decision concerning the interim measures did not affect the property registration and consequently did not produce the expropriatory effect alleged in that claim. Nevertheless, it is only in the closing arguments that it becomes unmistakably clear that the individual right derived from the plaintiffs’ ownership to which their counsel refers is possession, which is indeed one of the incidents of civil ownership under subsection 1° of Article 264 of the Código Civil. Because these are undivided rights, Article 270 of the same legal code must likewise be considered, without the relevant evidence having established how the plaintiffs, individually or collectively, exercised that possession. The testimonial evidence, at best, places only Nombre18250 at the site—if we accept the testimony of Mr. Nombre30489—so it cannot be shown that the activity conducted there was performed, individually or collectively, by both plaintiffs; the testimony of the other witness, Mr.
Nombre23689, is immaterial. Fourth, there is also a lack of precision between the allegation that the plaintiffs’ possession was purportedly impaired and the claims for relief, which refer not to the exercise of that incident of ownership, but to a different one: usufruct (usufructo) as derived from property ownership, as may be seen from the second claim. In this regard, given that the effect of the repeatedly cited ruling 108-2016-II was to affirm the cited interim measures, it must be understood that, from the standpoint of neither possession nor usufruct of the plaintiffs’ registered property, the interim effects fell directly upon the holding of a physical area—specifically, the disputed area—and that the decision established that this area had to be preserved until it was determined whether, based on its location, it belonged to the plaintiffs’ registered property or to Parque Nacional Tortuguero.
Thus, the material scope of the conduct was confined to the holding—direct control or the direct performance of material acts over a thing—which, as noted, had temporary effects pending the issuance and finality of the judgment on the merits in proceedings 06-001333-0163-CA and 07-001253-0163-CA. Nevertheless, it bears repeating that the plaintiffs failed to establish that the decision of Section II of the Tribunal de lo Contencioso Administrativo, acting as an appellate court, to affirm the interim measures affecting the holding of a physical area whose ownership was disputed—private property or national park—was detrimental to their individual rights, whether ownership as a whole, possession, or usufruct. This is particularly so given that, after that decision, it has not been established that the Administration of Justice operated improperly or defectively with respect to that criterion.
Consequently, this panel of judges concludes that there was a duty to bear the effects of the interim measure and that the elements necessary to sustain any of the plaintiffs’ claims have not been established. This includes their claim for fair compensation (justiprecio) for their registered property, since they still own it, though not at the location they desired or claimed. Accordingly, any compensation for the value of commercial and noncommercial forest resources, pastureland, works, and structures is unwarranted, because those were ultimately determined to form part of Parque Nacional Tortuguero and, logically, do not physically correspond to their registered property. The plaintiffs’ claim for subjective emotional distress (daño moral subjetivo) meets the same fate, because they failed to establish the unlawful basis of the judicial conduct that would give rise to an obligation to compensate them. Accordingly, all claims asserted in the complaint must be rejected, and the action must be dismissed in its entirety.
Because the defenses of a preliminary issue (prejudicialidad) were resolved by interlocutory ruling and the defense of defective pleading was withdrawn, it remains only to address the defense of lack of legal entitlement (falta de derecho), which, given the manner in which this matter has been decided, must be sustained in its entirety.
Regarding costs, pursuant to section one hundred ninety-three of the Code of Administrative Litigation Procedure, procedural costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed on the unsuccessful party by virtue of having lost. Relief from this award is available only when, in the Court’s judgment, there was sufficient cause to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, the Court finds no grounds for exemption from costs; therefore, they shall be borne by the plaintiffs and shall accrue statutory interest from the date on which the decision setting their amount becomes final until payment in full.
POR TANTO
Based on the foregoing findings of fact and conclusions of law, the defense of lack of legal entitlement (falta de derecho) is upheld in its entirety. Accordingly, the present action filed by Nombre18250 and Nombre18250 against the STATE is hereby DISMISSED. Both categories of costs shall be borne by the plaintiffs and shall accrue statutory interest from the date on which the decision setting them becomes final until payment in full. Notice shall be served.

CONSIDERANDO
De importancia para la resolución del presente asunto:
De importancia para resolver esta litis, se tiene como no demostrado lo siguiente: 1) La fecha exacta y detalles del desalojo realizado a los acá actores. (Los autos). 2) Que las matrículas del Partido de Limón números Placa5291 y Placa5292 hayan sido cerradas o canceladas en ocasión de los procesos judiciales tramitados bajo los expedientes Placa5293 y Placa5294. (Los autos). 3) La demostración de un error judicial en la sentencia 108-2016-II emitida por la Sección Segunda del Tribunal Contencioso Administrativo y Civil de Hacienda. (Los autos). 4) La existencia de amenazas por parte de funcionarios del Minae en menoscabo de la dignidad de los actores. (Los autos).
En este proceso, las partes actoras solicitan una indemnización con fundamento en haber sido, en su criterio, despojado de manera ilegítima, del aprovechamiento del inmueble del cual son titulares. Exponen que la finca estaba destinada a sistema agroforestal, parte en potrero con treinta hectáreas de pasto mejorado, dedicada al pastoreo de ganado, debidamente cercado con alambre de púas, carriles debidamente limpios, todo desde su adquisición en el 2001. Que, con el decreto 27227 de 1998, la finca quedó enclavada en la ampliación del Parque Nacional Tortuguero. Señalan que, producto de la resolución de apelación 108-2016-II emitida en alzada de medidas cautelares decretadas en los expedientes 07-001253-0163-CA y 06-001333-0163-CA y que impactaba la finca de la cual los actores son dueños, por cuanto ordenó el desalojo de animales y personas, la abstención de realizar actividad sobre éste, drenajes, chapeas, eliminación, daño o destrucción de plantas, cobertura forestal, arbustiva o palmácea (cualquier tipo de árboles, arbustos o palmas; cambio de uso del suelo; y construcciones, así como corta de árboles o extracción de madera de áreas del Parque Nacional Tortuguero) y que no se apruebe ningún aprovechamiento forestal, se suspenda la ejecución de planes de manejo que estén en trámite - en caso de existir alguno- ni se resuelva pagar servicios ambientales, a la Municipalidad de Pococí, para que no se otorguen permisos de construcción, hasta no se resuelva el proceso.
Que en el mes de junio del 2017, funcionarios del MINAE amenazaron de que debían sacar los animales, que no debían permanecer en la finca y que iban a quemar la casa de habitación, corrales e iban a destruir cercas. A petición de la Procuraduría, a través de la procuradora Fallas Cubero, se procedió al despojo “inutilizándola como recurso sostenible, finca agropecuaria, afectando patrimonial, y llevándolos a un estado de pobreza inminente a los señores Nombre18250 y sus familias, debido a la solicitud y resoluciones judiciales, contrarias al ordenamiento jurídico”, pese a que, conforme los artículo 456 y 477 del Código Civil, son terceros adquirentes de buena fe, con lo que, la lesividad no debía afectarlos, sobre todo siendo que la matrícula no ha sido declarada falsa o nula, o usurpadora de bienes de dominio público. Explica que tal lesividad no es por razones de nulidad sino de oportunidad, por lo que no debe perjudicar los derechos subjetivos de los accionantes y que, en todo caso, no fue indemnizado conforme el artículo 45 Constitucional, Ley de Expropiaciones y 144 de la Ley General de Administración Pública.
Señala que la ausencia de esta indemnización se transforma en un daño patrimonial por el no aprovechamiento del recurso comercial un valor cincuenta millones de colones, seiscientos mil colones por mes por el no uso y alquiler de las treinta hectáreas de pasto, así como trescientos millones de colones por el valor del terreno. Por otra parte, dada las “amenazas por parte de funcionarios, y ahora el despojo, ha producido una situación angustiante, de incertidumbre, que causa una afectación sicológica y económica, pues el sustento económico ha disminuido en su totalidad en las familias de los aquí actores, que le han provocado afectaciones en su salud física y mental, por lo que procedo a liquidar por daño moral la cantidad de diez millones de colones, a cada uno”. En otros argumentos apunta que “Como se observa, si se trata de un acto administrativo propiamente dicho, está claro su modificación o extinción del acto administrativo, se da, se por revocación como extinción de un acto administrativo, por razones de oportunidad, conveniencia o mérito discrecionalidad-, por actos administrativos completamente valido y eficaz, así como la anulación de un acto que supone que el acto nunca ha sido valido o perfecto y las efectos que puede haber producido son precarios”.
Explica que, conforme el artículo 142, 144, 171, 173 y 183 de la LGAP estamos en presencia de una revocación y, como tal, debe acarrear una indemnización. En conclusiones, la parte actora señala que, en la génesis de este asunto, se identifica en la ampliación del Parque Nacional Tortuguero, que provocó que la finca quedase dentro del parque. Afirma que, en aquella época, la fundación Neotrópica compró terrenos en la zona, realizó un plano catastral general y luego traspasó todo al Estado para la ampliación del parque. Afirma categóricamente que los actores son propietarios de una finca inscrita en el registro y un derecho de posesión que lo acompaña, rechazando que se califique a los accionantes de precaristas. La señalada finca se originó de una información posesoria, siguiéndose todos los trámites: plano catastrado, Minae, Procuraduría, y la valoración judicial, sin que existiese, aún en el período de convalidación, oposición alguna a la existencia de la matrícula.
Explica que, posteriormente, se detectó un error con una coordenada de la finca, la cual se corrigió. En todo momento los actores mantuvieron la posesión. Posteriormente, con la lesividad, existió un tema de responsabilidad de Estado – Juez, generador de daños y perjuicios indemnizables, que es el objeto de este proceso. Destaca dentro de los errores que nunca se realizó el trámite de oficio, en lugar de la lesividad, que no se le notificase de la declaratoria de lesividad a los actores, violentándose el debido proceso, así como los principios de seguridad y certeza jurídica. Pero el gran problema es que, con ocasión de la declaratoria de lesividad, no se acompañó la respectiva indemnización ni del derecho subjetivo de propiedad ni el de posesión, sino que se procedió al desalojo, que califico de despojo ilegal, de los acá actores, ello en contravención a lo dispuesto por la Ley General de Administración Pública artículos 141, 142, 143, 155, 175 y 183, así como 37 de la Ley del Ambiente al no haber respetado los derechos subjetivos. Su criterio es que, junto con la lesividad debió acompañar la indemnización de daños y perjuicios.
Señala la representación de la Procuraduría en la contestación y en conclusiones que, conforme la prueba obrante en autos, los actores adquieren la finca en escritura pública asociada al plano catastrado L-655208-2000 que se ubica fuera de cualquier área protegida. Posteriormente, levantan dos planos, uno en el 2004 y otro en el 2006, que los ubican dentro del Parque Nacional Tortuguero, siendo éstos posteriormente asociados a las matrículas de los actores. Así, en el año 2007, se presenta una lesividad para atacar los planos catastrados y los movimientos registrales de la finca, a su vez, esta causa, la 07-001253-0163-CA, se acumuló al 06-001333-0163-CA, siendo ambos resueltos en sentencia firme del año 2017. Dentro de estos procesos, se dictaron medidas cautelares, que fueron confirmadas por sentencia de apelación de la Sección II 108-2016-II, que es la que el actor considera causa del despojo.
El actor pretende reabrir la discusión de aquellos procesos y que fueron rechazados en el recurso de casación, donde expuso los mismos argumentos que se discuten acá (debido proceso, trámite de la lesividad y reclamo de daños y perjuicios). Así, en la audiencia preliminar de esta causa, del 17 de febrero de 2021, el actor limita como acto generador de daño la señalada resolución de la Sección II solamente, basándose en la supuesta responsabilidad Estado-Juez para cobrar daños y perjuicios de las matrículas y daño moral subjetivo. Aclara que los actores aún son dueños registrales de sus respectivas matrículas conforme las imágenes 405-408 del expediente judicial. Así, limitándose a la señalada resolución judicial, los actores no llegan a desacreditar que fuesen erróneas, arbitrarias o contrarias a derecho. Nota que, toda la argumentación de los actores, sobre todo lo dicho en conclusiones, no refieren al acto judicial objeto del proceso, sino a la referida lesividad, que es diferente.
Considera que el ajuste de las medidas cautelares es acorde a la sentencia de fondo emitida seis meses después, conforme la resolución 1054-2017 de las 15:00 del 16 de junio de 2017, la cual declaró con lugar la lesividad y anuló los señalados planos, así como los movimientos registrales asociados a éstos, así como el voto 61-2017-II de la Sección Segunda en condición de apelación y posteriormente ratificada por voto de la Sala Primera de la Corte Suprema de Justicia 712-2018 de las 9:20 horas del 16 de agosto de 2018. Con ello, no se logra acreditar que haya habido un error en la aplicación del ordenamiento jurídico, sino que simplemente, es una desavenencia de parte con lo resuelto con efecto de cosa juzgada material, remarcando que sus pretensiones fueron ya conocidas y rechazadas en sentencia 1054-2017. Consecuencia de lo resuelto en aquella sede, queda claro que, el ejercicio posesorio que tenían los actores que, en la realidad, se encontraban dentro del Área Protegida, con lo que hace calificar su ocupación de ilegal, sin que se logra acreditar una afectación a un derecho subjetivo.
La base de la reclamación de los actores, que es la supuesta posesión de tales espacios físicos, tiene el problema de ser antijurídico en su base, al ser terrenos públicos, conforme los artículos 13 y 14 de la Ley Forestal, con lo que es erróneo de hablar de un despojo de su propiedad, sobre todo si consideramos que ellos son aún titulares de las respectivas matrículas, por lo que sus pretensiones no tienen asidero. Explica que el testigo Nombre23689 fue uno de los precaristas desalojados, al igual que el testigo Nombre30489 , que pretendieron vía recursos de amparo, que fueron rechazados. En todo caso, al no existir responsabilidad de Estado-Juez las declaraciones de ambos testigos, resultan inconducentes. Finalmente, no existe causalidad entre la resolución objeto del proceso, la 108-2016-II y el supuesto despojo del 1 de junio de 2017. Reitera el rechazo de la demanda y la condenatoria de costas e intereses.
Este Tribunal ha indicado en múltiples ocasiones que la responsabilidad del Estado por las actuaciones jurisdiccionales ha sido objeto de estudio y controversia a lo largo del tiempo, pues por una parte se ha considerado que es necesario que se emita una ley para que se establezca su régimen de responsabilidad, según lo establece el artículo 154 de la Carta Magna, mientras que otros consideran que partiendo de los artículos 9 y 41 constitucionales, puede fundamentarse la indemnización de los daños causados por esta función jurisdiccional. Esta última posición es la que ha tenido aceptación, tanto por la Sala Constitucional, como por la Sala Primera, ambas de la Corte Suprema de Justicia. De interés es citar entre la sentencia de la Sala Primera, 654-F-S1-2008, de las diez horas cuarenta y cinco minutos del veintiséis de setiembre de dos mil ocho, que a la letra dispuso: "En la dinámica propia de un Estado Social y Democrático de Derecho (como el que se mantiene en Costa Rica) -precepto primero de la Carta Magna-, las relaciones que se generen entre las personas y los poderes públicos, están sujetas al control de legalidad y a la responsabilidad que se deriva de la conducta estatal, siempre que hubiere generado un daño que la víctima no tenga el deber jurídico de soportar (antijuridicidad de base).
La sujeción del Estado al Derecho y el régimen de responsabilidad por daños constituyen parte de los grandes logros de este modelo de régimen democrático. Tal visión Social de Derecho es precisamente el resultado de la sumatoria de principios inclaudicables que la impregnan y que conforman un conjunto de garantías, a saber: legalidad, control universal de las conductas estatales y un sistema de responsabilidad pública. Desde este plano, los poderes públicos ostentan potestades que le son conferidas para el cumplimiento de un fin (satisfacción de intereses generales), de manera tal que permitan la concreción de los valores de justicia, igualdad e indemnidad patrimonial que impone el ordenamiento jurídico. Si el Derecho empodera al Estado en sus distintas funciones (ejecutiva, legislativa y judicial), la consecuencia lógica y natural de ese efecto, es la imposición de un sistema de responsabilidad que permita la reparación de los efectos lesivos que su proceder pueda generar en la esfera jurídica de las personas (lo que incluye la tutela de los derechos subjetivos y los intereses legítimos).
Estos postulados han tenido mayor desarrollo en la arista de la responsabilidad de la Administración Pública, con una evolución cuya trascendencia ya ha sido evidenciada por parte de la jurisprudencia de esta Sala, entre muchas, en el fallo no. 584 de las 10 horas 40 minutos del 11 de agosto del 2005. V.-Lo anterior encuentra sustento en el propio marco del Derecho de la Constitución. El Principio de Responsabilidad Pública se encuentra reconocido de manera expresa en el numeral 9 de la Carta Magna en cuanto señala: “El Gobierno de la República es popular, representativo, participativo, alternativo y responsable. Lo ejercen el Pueblo y tres Poderes distintos e independientes entre sí. El Legislativo, el Ejecutivo y el Judicial….”. Así mismo, encuentra desarrollo y complemento en el principio de legalidad (artículo 11), equidad en la distribución de las cargas públicas (ordinales 18 y 33), tutela de las situaciones jurídicas y derechos consolidados (precepto 34), reparación integral del daño (artículo 41), indemnidad patrimonial (canon 45), tutela judicial efectiva (mandato 49), máxima de solidaridad social (74 constitucional), responsabilidad del cargo presidencial (148 ibidem), responsabilidad del Poder Judicial (154 y 166 ibidem), responsabilidad de las instituciones autónomas (numeral 188).
Estas normas constituyen las bases del referido sistema, que exige la reparación económica de las lesiones patrimoniales o extrapatrimoniales ocurridas como derivación de conductas u omisiones públicas. En el caso de la responsabilidad por la actuación del Poder Judicial, el fundamento ha sido tema de desarrollo por parte de la Sala Constitucional, en cuya sentencia no. 5981 de las 15 horas 41 minutos del 7 de noviembre de 1995 señaló en lo pertinente: “V. DE LA RESPONSABILIDAD OBJETIVA DEL PODER JUDICIAL. PRINCIPIOS. (…) La responsabilidad del Estado derivada del ejercicio de la función jurisdiccional debe regirse de conformidad con lo establecido en la propia Constitución Política y en la ley, según lo dispuesto en la Carta Fundamental en su artículo 154 (…): "El Poder Judicial sólo está sometido a la Constitución y a la Ley, y las resoluciones que dicte en los asuntos de su competencia no le imponen otras responsabilidades que las expresamente señaladas por los preceptos legislativos."; de lo cual se derivan dos conclusiones básicas: 1.) En primer término, constituye un principio constitucional la responsabilidad directa del Estado en los casos de error judicial y funcionamiento anormal de la administración de justicia, la cual deriva precisamente de lo dispuesto concretamente en el artículo 9 constitucional, (…) en relación con los artículos 11, 33, 41 y 154 constitucionales, y que resulta congruente con los principios del Estado Social de Derecho, precisamente con el de interdicción de arbitrariedad de los poderes públicos, el de seguridad jurídica e igualdad de todos los ciudadanos ante la ley.
Esta responsabilidad se justifica por el hecho de que la función de juzgar es manifestación de un Poder, uno de los tres del Estado, lo cual implica su condición de servicio público, de organización de medios materiales y personales destinados a la satisfacción de la demanda social de justicia. […] En virtud de lo dispuesto en los transcritos artículos 9 en relación con el 153 constitucionales, en consonancia con el principio general de que "todo aquel que causa un agravio debe repararlo", no podría eximirse de responsabilidad al Poder Judicial por el "error judicial" en el ejercicio de la función jurisdiccional. Cabe señalar que esta responsabilidad objetiva del Estado resulta complemento de la responsabilidad civil, penal y disciplinaria a que está sujeto el juez, pues éstas no resultan suficientes para garantizar debidamente los intereses de los justiciables, que por las dificultades para su exigencia, convierten en una verdadera carrera de obstáculos la posible reclamación, y en la mayoría de los casos, deja al margen y sin protección aquellas situaciones en las que no es posible apreciar el dolo o culpa del juzgador.
La responsabilidad debe provenir de una conducta dolosa o culposa del órgano jurisdiccional, constitutiva o no de delito (responsabilidad por falta).” Sobre el tema, puede consultarse además, de esa misma Sala, resolución no. 5207-2004, de las 14 horas y 55 minutos del 18 de mayo del 2004." (El destacado no es del original). Hay que hacer una diferenciación importante con respecto a la responsabilidad de las Administraciones Públicas, pues si bien podrían compartir algunos aspectos generales, como el tipo de daño indemnizable, eximentes de responsabilidad y necesidad de un daño efectivo e individualizable, parten de un supuesto normativo diferente, que es precisamente el desarrollo legal de la LGAP, con respecto al régimen objetivo de la Administración, que no puede asimilarse en su totalidad al del Estado Juez, pues como acaba de indicarse, ésta descansa en el error judicial, mientras que la primera sobre la obligación de las Administraciones de responder por todas sus actuaciones tanto lícitas como ilícitas, así como por su funcionamiento normal o anormal.
En ese escenario, como se dijo anteriormente, lo que el Juzgador debe de hacer, es verificar la forma en que se dictó la resolución judicial eventual generadora de responsabilidad, sin que pueda entrar a valorarse las actuaciones de los jueces, pues esta instancia no es revisora de las mismas, sino que viene a decidir únicamente en cuanto al tema de la responsabilidad del Estado, para definir su procedencia y eventualmente verificar la existencia de los daños y su cuantificación.
LIMITACIÓN DEL OBJETO DEL PROCESO. El principio dispositivo, unido al principio pro actione, indican que la acción, encarnada en la manifestación de la parte que se convierte en demandante, está limitada o circunscrita a la voluntad de ésta a través de la formulación de las pretensiones que se configuran como los pedimentos sobre los cuales el juez debe verter pronunciamiento. Por ello, ni las demás partes, ni el juez, tienen la posibilidad de manipular las petitorias de la parte, convirtiéndose en el núcleo de la acción, que se complementa con la narración fáctica que sustenta tales peticiones (hechos) y la respectiva prueba para acreditar lo anterior, amalgamado en la exposición de razones que, en su criterio, justifican los motivos para que el juez le otorgue la razón (fundamentos de derecho), sumando así todos los anteriores elementos, en lo que se conoce comúnmente como la teoría del caso que expone la demanda.
Así, las demás partes, ya sean demandados, terceros o coadyuvantes, o en general, cualquier otro sujeto procesalmente permitido, puede enmarcar el escenario en disputa, el cual, se reitera, se origina de la acción de la parte promotora de la demanda, para así evitar discusiones impertinentes o inconducentes (extra litis) que distraigan del objeto litigioso. Para el caso en marras, la parte accionante limitó, específicamente en la audiencia preliminar, a que sus pretensiones se circunscribiesen, únicamente, a la resolución judicial 108-2016-II de la Sección Segunda del Tribunal Contencioso Administrativo y Civil de Hacienda de las catorce con veinte minutos del veintiuno de diciembre de dos mil dieciséis, y que señala como causa productora del daño, bajo la tesitura de responsabilidad Estado-Juez, y sobre tal, exige la indemnización que materializa en sus pretensiones. Así, el análisis de fondo, se determinará si existen los elementos configuradores de responsabilidad objetiva o no, que sustenten tales petitorias, tomando en consideración que la resolución señalada de manera puntual confirma una medida cautelar emitida en instancia del Juzgado Contencioso Administrativo, ergo, hemos de entender que se trató de una medida intraprocesal, limitando los efectos contabilizados desde la emisión de la sentencia de apelación objeto del proceso y la emisión de la sentencia de fondo, ya que ésta es la que sustituye los efectos provisionales cautelares, para sustituirlos por la definición de la situación jurídica de fondo al emitirse la sentencia respectiva, es decir, encontramos un efecto delimitado temporalmente.
Por otra parte, consecuencia del mismo razonamiento, no es objeto de este proceso lo resuelto en instancia, en alzada o en casación dentro del legajo principal de los procesos 06-001333-0163-CA y 07-001253-0163-CA, ya que se encuentran fuera del objeto de la litis, pese a que, en la línea argumentativa de la demanda, réplica, así como las conclusiones, la parte actora se encaminó a atacar lo resuelto en las lesividades de aquellos procesos, lo que resulta en argumentos ayunos de utilidad al no estar unidos a una pretensión procesal.
Hemos de recordar que, bajo el criterio de imputación de responsabilidad objetiva de la Administración, se necesita un ejercicio de identificación causal entre el agente responsable (Administración), la conducta reprochada, el tipo de daño y resultado dañoso concreto y su vinculación con quien sufre éste, cada uno de ellos, con la necesaria acreditación de causalidad y cumpliendo el daño con los requisitos exigidos, a saber: el no deber de soportar el daño o la base antijurídica de la conducta, la certeza y determinabilidad de éste, la ya referida causalidad y la actualidad del daño. Como se expuso en el considerando anterior, el proceso circunscribe la conducta reprochada a una resolución judicial de alzada, bajo el criterio de imputación de Estado-Juez. Después de depurar los argumentos de los actores, emanados a través de su representación, encontramos que el objeto de análisis ha de fijarse en los efectos de la resolución 108-2016-II y, al tratarse de materia cautelar, del lapso temporal en que ésta surtió efectos, teniendo como hito final la sentencia de fondo de los procesos 06-001333-0163-CA y 07-001253-0163-CA.
En cuanto a la motivación que se da para cuestionar lo resuelto, señala que tal actuación dio pie a un despojo injustificado y una afectación a los derechos subjetivos de las partes, ya que ellos son titulares de una matrícula inmobiliaria de la cual derivan un derecho legítimo de posesión para la explotación, goce y disfrute de la franja de tierra de la cual fueron despojados, sin indemnización previa, generando daños y perjuicios que son los que reclama en la acción. Criterio del Tribunal: La tesis del actor no cumple con los elementos suficientes para acreditar la existencia de responsabilidad de Estado – Juez que reclama, por las razones que de inmediato se explicarán. Primero, la pieza fundamental del régimen que pretende utilizar la representación accionante, parte de la demostración de la existencia de un error o vicio en una actuación jurisdiccional, lo cual debe hacerse, en el mejor de los casos, en la propia vía en la cual se origina o enmarca la actuación en cuestión, siendo excepcional la posibilidad de este tipo de declaraciones como lo es en el caso del prevaricato en materia penal.
Así, si a través de los medios respectivos se acreditase por la autoridad competente la irregularidad de la conducta judicial, ello daría pie para fundamentar una acción como la que se pretende. Y es que la naturaleza de la resolución objeto de este proceso, muestra una errónea concepción que posee la parte actora, ya que la conducta que achaca a ésta, sea, la decisión cautelar de interrumpir la actividad y desalojar el espacio que ocupaban ambos actores previamente, no provino de la resolución 108-2016-II, sino de las resoluciones de instancia 1335-2013 y 1336-2013 (hechos probados 3 y 4 de esta sentencia), entonces, limitándonos al rol que ejerce en alzada la Sección II del Tribunal Contencioso Administrativo, a éste le asistían cuatro posibles conductas frente al conocimiento de un asunto sujeto a apelación: o rechaza por inadmisión cuando el recurso es improcedente o extemporáneo, revocación de lo resuelto, ya sea total o parcial, procediendo directamente a decidir lo que corresponda sin devolver al a quo; otra opción es la anulación de lo resuelto con efectos devolutivos y, finalmente, la confirmación de lo resuelto, que es justamente lo que ocurrió con la sentencia 108-2016-II.
Por ende, la carga probatoria (onus probandi) de la acreditación de la irregularidad en el ejercicio de la facultad confirmatoria materializada en la resolución en cuestión, recaía sobre la parte accionante, cosa que no ocurre en autos. Nótese que no existe prueba alguna de que la actuación judicial haya sido confirmada en alguna sede (la original donde se emanó la actuación u otra) como irregular, ni tampoco se aportan elementos en esta acción encaminadas a demostrar este componente básico necesario para acreditar la antijuridicidad de la actuación. Recordemos, este proceso no es una instancia revisora de otras jurisdiccionales, sino que tiene la tarea valorativa de determinar si, los efectos de tales resoluciones pueden configurarse como acciones dañosas de base indemnizable. En este caso, no se cumple con este requisito, llevando razón la representación del Estado al afirmar que, en el fondo, lo que se trata es de una disconformidad de la parte actora con lo resuelto en aquella otra instancia judicial, sin demostrar componentes como desproporcionalidad, irracionalidad o en general, algún vicio en el ejercicio jurisdiccional ejercido en alzada que tiene la tarea, como Ad Quem, de conocer del instrumento recursivo vertical de apelación.
Segundo, el cuadro fáctico lo que brinda es la existencia de una decisión judicial que se ajusta a los parámetros de legalidad en el ejercicio competencial de valoración en recurso vertical de una medida cautelar. En este sentido, el hecho de que tal decisión confirmase las resoluciones 1335-2013 y 1336-2013 y que éstas trajesen efectos ablativos o perniciosos en términos de los intereses de los accionantes, no convierte, por ese simple hecho, en una situación jurídicamente tutelable, en tanto el ordenamiento cautelar permite la existencia de medidas conservativas, modificativas o innovativas, las cuales pueden generar un desbalance sobre las partes, beneficiando a una y eventualmente perjudicando a la otra, ejercicio valorativo que se realiza a través de los componentes de la medida cautelar peligro en la demora, apariencia de buen derecho, instrumentalidad y sobre todo, la ponderación de intereses en juego.
Así, en este caso en la resolución objeto de discusión se detallan con extrema precisión, el análisis de cada uno de estos componentes, los cuales se emitieron al tenor de la prueba obrante en aquellos autos, sin que en este proceso la parte actora haya acreditado un ejercicio patológico del actuar jurisdiccional. Tercero, téngase en cuenta que, existe un error en la apreciación de la parte actora, por cuanto lo resuelto en la resolución 108-2016-II no afectó directamente el derecho de propiedad de los actores, sino la tenencia (identificación de tal derecho sobre un espacio físico específico), sobre todo, tal y como se acredita con el hecho probado 1 de esta sentencia, los accionantes aún son titulares de los derechos indivisos 001 y 002 de la matrícula Placa5295 de la Provincia de Limón, por lo que, la expresión utilizada por la representación actora de afectación a los “derechos subjetivos” de los demandantes, no precisa, con exactitud, a qué tipo de lesión se refiere y a cuál o cuáles derechos hace referencia, utilizándolo como una expresión genérica indeterminada, quedando acreditado la evidente improcedencia de la pretensión primera, en tanto lo resuelto en alzada en contra de las medidas cautelares, no afectó la matrícula inmobiliaria y por ende, no se genera el efecto expropiatorio al que hace referencia tal pretensión.
No obstante, es hasta conclusiones que, de manera meridiana, se extrae que el derecho subjetivo derivado de la propiedad de los actores al que hace referencia la representación actora es la posesión, que es, efectivamente, una de las manifestaciones del dominio civil en términos del inciso 1° del artículo 264 del Código Civil, el cual, por tratarse de derechos indivisos, tenemos que considerar de igual manera el 270 del mismo cuerpo legal, sin que se haya acreditado a través de la prueba respectiva la forma en cómo los accionantes a nivel individual o colectivo ejercían tal posesión. Véase que, con la prueba testimonial, en el mejor de los casos, al único que logra ubicarse en sitio es a Nombre18250, -si tomamos la deposición del señor Nombre30489 -, por lo que no podemos demostrar que la actividad ahí realizada, correspondía, individual o colectivamente, a ambos actores, siendo inconducente la declaración del otro testigo, el señor Nombre23689 .
Cuarto, por otra parte, también existe una imprecisión entre el argumento señalado de presunta afectación a la posesión de los accionantes y las pretensiones, las cuales refieren no al ejercicio de esa atribución de la propiedad, sino a otra distinta, que corresponde al usufructo como derivación de la titularidad inmobiliaria, como se desprende de la pretensión dos. A ello, en el entendido que, los efectos de la harta citada resolución 108-2016-II, lo que vino fue a confirmar las medidas cautelares citadas, hemos de entender que, no desde la perspectiva de la posesión, ni del usufructo de la matrícula de los actores, los efectos cautelares recayeron directamente sobre la tenencia de un espacio físico, concretamente, del espacio en litigio, siendo que lo resuelto lo que vino a definir es que, tal espacio, debía reservarse hasta que se determinase si éste pertenecía en su ubicación o a la matrícula de los actores, o al Parque Nacional Tortuguero.
Así, la materialidad de la conducta se circunscribió a la tenencia (poder directo o ejercicio directo de actividades materiales sobre una cosa), la cual, como se señaló, tuvo efectos temporales mientras acaecía la sentencia de fondo y la firmeza de ésta dentro de los procesos 06-001333-0163-CA y 07-001253-0163-CA. Con todo, se reitera, la parte falla en acreditar que dicha decisión del Tribunal de lo Contencioso Administrativo, Sección II en función de Tribunal de Apelaciones, de confirmar las medidas cautelares con efectos sobre la tenencia de un espacio físico que se discutía su titularidad (propiedad privada o parque nacional), vino en detrimento de sus derechos subjetivos, llámese dominio como un todo, posesión o usufructo, sobre todo en el entendido de que, con posterioridad a esta decisión, no se ha acreditado que existiese un mal o defectuoso funcionamiento de la Administración de Justicia sobre tal criterio.
Consecuentemente, concluye esta Cámara de Juzgadores que existe el deber de soportar los efectos de la medida cautelar, no configurándose los elementos necesarios para aceptar alguno de los reclamos planteados por los actores, sean, el reconocimiento de un justiprecio por su matrícula, dado que aún la poseen, solamente que no en la ubicación que ellos deseaban o pretendían, por lo que resulta improcedente cualquier reconocimiento por el valor de un recurso forestal comercial y no comercial, potrero, obras y construcciones, que finalmente se definió como parte del Parque Nacional Tortuguero, y lógicamente, no corresponden físicamente a su propiedad registralmente inscrita. Misma suerte corre la pretensión de daño moral subjetivo de los accionantes, que no logran acreditar la base antijurídica de la conducta judicial que motive la creación de una obligación indemnizatoria a su favor. Con ello, todos los elementos reclamados en la demanda, han de rechazarse, con lo que la acción debe declararse sin lugar en todos sus extremos.
Habiéndose resuelto las excepciones de prejudicialidad interlocutoriamente y desistida la de demanda defectuosa, resta solamente referirse a la defensa de falta de derecho, la cual, por la forma en cómo fue resuelto este asunto, ha de acogerse en su totalidad.
Respecto a las costas, de conformidad con el numeral ciento noventa y tres del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena sólo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, el Tribunal no ubica algún motivo para exonerar en costas, por lo que procede imponerlas a cargo de los actores, las cuales generarán intereses legales a partir de la firmeza de la resolución que determine su fijación y hasta su efectivo pago.
POR TANTO
Con base en los fundamentos de hecho y derecho expuestos, se acoge la defensa de falta de derecho en su totalidad. Consecuentemente se declara SIN LUGAR la presente demanda interpuesta por Nombre18250 y Nombre18250 , en contra del ESTADO. Son ambas costas a cargo de los actores, a los cuales se les sumarán los intereses legales a partir de la firmeza de la resolución que las fije y hasta su efectivo pago. Notifíquese.
