Judge Francini Quesada Salas and associate judges Gustavo Gillen Bermúdez and Alberto García Chaves participated in deciding the appeal. Msc. BACKGROUND:

I.By judgment number 386-2021, issued at sixteen hundred hours on June sixteenth, two thousand twenty-one, the Tribunal Penal del Primer Circuito Judicial de la Zona Atlántica, Limón, ruled: “WHEREFORE (POR TANTO): In accordance with the foregoing, the rules of sound judicial evaluation (sana crítica), Articles 39 and 41 of the Constitución Política, Article 8 of the Convención Americana de los Derechos Humanos, Articles 14 and 15 of the Pacto Internacional de Derechos Civiles y Políticos, Articles 1, 30, 31, 45, 103, and 227 subsection 1) of the Código Penal; Articles 2 and 4 through 8 of the Ley de Zona Marítimo Terrestre; Articles 122 through 138 of the Código Penal de 1941 concerning the Reglas Vigentes Sobre Responsabilidad Civil; Articles 1 through 6, 11 through 13, 16, 37 through 41, 70, 71, 75 through 83, 91, 92, 94, 95, 97, 111 through 124, 142, 143, 180 through 184, 265 through 270, 308, 360 through 365, and 367 of the Código Procesal Penal; and Articles 632, 704, and 1045 of the Código Civil, this Court rules as follows: A.- The claim of defective procedural activity (Actividad Procesal Defectuosa) filed by attorney Álvaro Moreno is denied.

B.- Nombre03 AND Nombre01 are acquitted of all punishment and liability for the acts charged and alleged against them, which had been characterized as constituting the offense of ENCROACHMENT UPON PUBLIC-DOMAIN PROPERTY, alleged to have been committed to the detriment of the State. C.- The civil claim for damages (acción civil resarcitoria) filed by the Procuraduría General de la República against the civil defendants (demandados civiles), Nombre03 and Nombre01, is granted, and the civil defendants shall be jointly and severally liable for the damage caused by their possession (detentación) of public-domain property, specifically the Public Zone (Zona Pública) of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) in the Portete area. This award is made without fixing an amount (en abstracto) because there is no evidence providing objective parameters by which the specific amount of compensation may be established; the party must therefore seek quantification through judgment-enforcement proceedings (vía de ejecución de sentencia).

In addition, the civil defendants are ordered to pay both categories of costs associated with this action, namely attorney fees and procedural costs (costas personales y procesales), which are also awarded without fixing an amount because there is no monetary amount upon which to calculate them. The unsuccessful party is likewise ordered to pay statutory interest on those sums from the date the judgment becomes final until payment in full, at the interest rate established by Banco Central de Costa Rica. D.- Restitution to the State of the area within the Public Zone at issue in these proceedings is ordered, as is the demolition of the structures described in the charging instruments and the civil action and identified in the relevant recital (considerando) of this judgment, because they are located within the Maritime-Terrestrial Zone, which is an inalienable area; the site must also be cleaned.

The Municipalidad de Limón, as the authority responsible for administering that area, shall carry out the demolition within a non-extendable period of three months from the date this judgment becomes final. Failure to proceed as ordered may constitute the offense of Disobedience of Authority (Desobediencia a la Autoridad). The costs of demolishing the structures and cleaning the area shall be charged to the defendants and other persons involved. E.- The precautionary measure (Medida Cautelar) ordered in the case is maintained insofar as it provisionally granted possession to the Policía de Guardacostas de Limón so that it may continue guarding the site. That measure was ordered for the duration of the proceedings and shall therefore remain in effect until this judgment becomes final. Once it becomes final, all structures shall be destroyed, including those occupied by the Policía de Guardacostas.

The costs of the criminal proceedings shall be borne by the State. Once this judgment becomes final, the orders herein shall be executed and the case file archived. As to the physical evidence (prueba material), it is ordered destroyed once this judgment becomes final. Notice shall be given by reading” (sic).

II.Msc. Álvaro Enrique Moreno Gómez, attorney Juan José Picado Herrera, attorney José Alejandro Alpizar Arrones, and attorney Andrés Alfaro Ramírez filed appeals against the foregoing ruling.

III.After the corresponding deliberation was conducted in accordance with Article 465 of the Código Procesal Penal, the Court considered the issues raised in the appeal.

IV. The applicable legal requirements have been observed throughout the proceedings

Appellate Judge Quesada Salas drafts the judgment; and,

CONSIDERING:

I.Admissibility and Inadmissibility. By a brief filed on 13 de julio de 2021, private defense counsel Álvaro Enrique Moreno Gómez, representing defendants Nombre02 and Nombre01, and also representing Nombre04, Nombre05, Nombre06, Nombre07, Nombre08, and Nombre09 in their capacity as third-party civil defendants (terceros civilmente demandados), by means of a brief filed on 14 de julio de 2021; private defense counsel Juan José Picado Herrera, representing Nombre01; additionally, by a brief filed on 23 de julio de 2021, attorney José Alejandro Alpízar Arrones, representing the Ministerio Público; and, by a brief filed on 28 de julio de 2021, attorney Andrés Alfaro Ramírez, representing the Procuraduría General de la República, filed appeals—the first two direct appeals and the latter two appeals by joinder (apelación por adhesión)—against judgment number 386-2021, issued by the Tribunal Penal del I Circuito Judicial de la Zona Atlántica at 16:00 hours on 16 de junio de 2021, which acquitted Nombre03 and Nombre01 of all punishment and liability for the offense of encroachment upon public-domain property, to the detriment of the State.

A review of the record shows that the appeals were filed timely, within the statutory period, and in compliance with the requirements necessary for the challenges to permit proper and correct consideration of the appellants’ objections as part of a comprehensive review of the challenged judgment, as established by Article 8.2h of the Convención Americana sobre Derechos Humanos and governed by Articles 458, 459, 460, and 462 of the Código Procesal Penal.

II.Given that the joinder appeal (recurso de adhesión) filed by attorney Alejandro Alpízar Arrones, representing the Ministerio Público; the first ground of the joinder appeal filed by attorney Andrés Alfaro Ramírez, representing the Procuraduría General de la República; and the fourth ground of the appeal filed by attorney Álvaro Enrique Moreno Gómez challenge the reasoning of the judgment, they shall all be decided jointly. It is asserted that there is agreement with the acquittal entered, although it was based on incorrect grounds, which led to an award of monetary damages in favor of the Procuraduría General de la República and against the defendants. It is argued that the ruling transcribes the statements made by the witnesses but provides no assessment whatsoever of them. It is contended that the defendants should not have been acquitted based on the application of a mistake of law (error de prohibición), but rather because the conduct did not constitute a criminal offense (atipicidad de la conducta), and therefore no criminal wrong (injusto penal) was established.

It is again insisted that Nombre10 beach falls within the provisions of ley 6043. The criterion of the trial court is rejected insofar as it validated a 1980 official letter from the director of the Instituto Nacional Geográfico to locate the coordinates of Nombre10 in another place known as Playa Bonita and, on that basis, to find that Playa Nombre10 is not within the urban area of the city of Limón. The trial court is criticized for holding that the coordinates set forth in that official letter had to be treated as the city limits, even though that reasoning was contrary to law. It is insisted that the core issue is not whether Nombre10 is part of the Maritime-Terrestrial Zone (zona marítimo terrestre), but rather that the defense argued that the coastal area (zona litoral) of Portete is a neighborhood of the coastal city of Limón and is therefore an area excluded from the application of the provisions of ley 6043 governing the Maritime-Terrestrial Zone; the defense rejected the use of a 1980 official letter from the Director del Instituto Nacional Geográfico, in which the coordinates of Nombre10 had been placed at another location known as Playa Bonita, to justify the conclusion that the Nombre10 area lies outside the city limits.

According to the defense, the coastal area of Nombre10 and its bay are not located within the 50-meter public zone (zona pública) measured from the high-tide line (pleamar), and the provisions of Ley 6043 concerning restrictions in the Maritime-Terrestrial Zone are, it is insisted, inapplicable to Playa Portete because it forms part of the urban area of the coastal city of Limón. It is argued that, on this basis, privately owned properties with boundaries extending to the Caribbean Sea may be recorded in the Property Registry, structures may be built alongside the water surface or up to the ordinary high-tide line, and the Municipalidad de Limón is the entity authorized to issue administrative acts at that location. It is also argued that, under these circumstances, lawful commercial tourism and fishing activities adjacent to the sea are permitted in the “public zone” of the city of Limón, which includes “Playa Portete,” at Playa Bonita, Pitua, and the city center, where activities are conducted under the same conditions as those of the occupants of Portete.

It is further explained that the restrictions applicable to the Maritime-Terrestrial Zone do not apply within the coastal city of Limón, which is why the Poder Judicial de Limón building is located near the sea in the city of Limón. It is asserted that fishing activities are promoted as being in the national interest and that Article 5 of the Ley de Pesca y Acuicultura therefore protects such activity, which led to the enactment of leyes 9073 a la 9577, protecting fishers against evictions and demolitions. It is explained that the most recent law in this regard was the law enacted on 1 de julio del 2021, ley número 10000, which orders the suspension of evictions in the Maritime-Terrestrial Zone and of actions obstructing lawful commercial activities until 1 de julio del año 2024. It is also argued that the Concejo Municipal even agreed to construct a fishing terminal in Bahía de Portete together with Japdeva and Incopesca, in accordance with the zoning plan (plan regulador) and the needs of the canton.

As a second ground of disagreement, it is reiterated that the defendants’ conduct did not constitute a criminal offense and that the trial court’s determination that the conduct was statutorily defined as an offense (típica) and unlawful (antijurídica), but not culpable (culpable), was therefore legally untenable. It was emphasized that the accused did not act with criminal intent (dolo), because they had neither knowledge of nor the intent to possess State-owned land. It is asserted that the property on which the fishers lived belonged to Nombre11, a property that has a deed, a registered survey plan, and boundaries extending to the high-tide line; it is therefore insisted that the fishers were unaware that they were committing the alleged offense or, at the very least, did not imagine that this was possible. It is added that the accused were criminally charged and subjected to a private criminal complaint (querella) for possessing public-use property (bien demanial) or property in the public domain (dominio público), referred to as the “public zone,” although it has not yet acquired public-domain status; it is therefore insisted that the judgment, in bad faith, disregarded the northern boundaries shown in the property-registration studies updated as of today for the property where the accused lived.

It is also argued that it was never established that, when the defendants were permitted to use and occupy as dwellings the two structures they had used as homes since before año 1991, which stood on part of Nombre11’s private property and had been lawfully registered since before 1977, those lands had been declared public-domain property, much less that their expropriation by the State had been ordered. Moreover, it was asserted that they were never formally ordered to vacate the premises. It is argued that, before charging them with the act of “possessing” the property, they should have been warned to return it to its owner. It is insisted that both defendants had the right to possess the property because its owner had granted it to them; their lawful possession (posesión legítima) had therefore not been disturbed, and it likewise could not be maintained that they unlawfully possessed that property.

The appellant questioned whether judicial officer Nombre12 actually possessed sufficient knowledge regarding the application and interpretation of the laws in force with respect to Playa Portete for the court to base its decision on that knowledge. It was argued that Nombre13’s testimony concerning the Ley de Zona Marítima Terrestre and the inapplicability of its regulations to Playa Portete was not analyzed. As a third ground of disagreement, it was argued that the Instituto Nacional Geográfico, hereinafter referred to as “ING,” responded that no boundary monuments (amojonamiento) existed in the Portete area, and therefore it could not determine whether the structures were located within the public zone protected by the Ley de Zona Marítimo Terrestre; in the appellant’s view, this disproved officer Nombre12’s assertions in that regard. As a fourth ground of disagreement with the judgment, it is alleged that the forensic expert reports (dictámenes criminalísticos periciales) prepared by forensic engineer Nombre14 of the Organismo de Investigación Judicial, together with 2 supplemental reports prepared in año 2015, were erroneously interpreted.

It is argued that reports número DCF-2015-00746-IG, DCF-2015-1247-ING, and DCF-2017-682-ING did not make it possible to establish the location of the Maritime-Terrestrial Zone with certainty because there were no boundary monuments in the area. It is further argued that the parameter used in those reports to define the coastline of the city of Limón was not the coordinates established by law, but rather the “Proyecto de Limón-Ciudad Puerto,” which is not based on the urban limits of the coastal city of Limón. It was also noted therein that there were no official boundary monuments for the Maritime-Terrestrial Zone at Playa Portete; consequently, it likewise could not be established that the study area was located next to the Área Recreativa Nacional Cariari, and no graphical information was obtained that would make it possible to identify the park’s boundaries. It is criticized that, in the supplemental report for expert report 2015-1247-ING, a public zone was marked despite the absence of boundary monuments, and the appellant further argued that the high-tide line does not coincide with the 50-meter strip (faja).

Report 746-ING-2015 stated that the public zone had been delimited digitally and that no physical boundary markers (mojones físicos) existed. It is then disputed that a sketch was included showing the structures under study as being located partly within the public zone and the high-tide area, without determining whether the accused’s houses were inside or outside that area. It is also noted that there was an error in the manner in which the sketch established the Maritime-Terrestrial Zone at Playa de Portete, which allegedly was drawn not from the high-tide line, as stipulated in Articles 9 and 10 of Ley 6043—that is, from the shoreline of Bahía de Nombre10 or from the structures—but much farther inland, thereby altering the width of the public-zone strip by extending it beyond the 50 metros from the high-tide line prescribed by law and creating an irreconcilable uncertainty regarding the location of the public zone.

Despite the findings of those reports, it is insisted, an eviction was ordered through the approval of an interim measure (medida cautelar). It was reiterated that report 2017-683-ING initially marked a public zone digitally on a sketch, without physical boundary markers, within the Portete Maritime-Terrestrial Zone; subsequently, the supplemental report established, for a second time, a different Maritime-Terrestrial Zone in which the high-tide line likewise did not coincide with the marked 50-meter strip or with what was indicated at folio 538 of the previous expert report. It was explained that the supplemental report to DCF-2015-1247-ING, which had been requested to measure the number of square meters occupied by each structure, again expanded the 50-meter zone or strip, placing it even farther from the high-tide line and in a position entirely different from that marked on the earlier sketch at folio 538.

It is disputed that the sketch at folio 538 placed the structures within the public zone, whereas the sketch at folio 1061 placed them outside the public zone, thus demonstrating the confusing nature of the expert evidence. It is argued that the expert evidence did not establish the public zone with certainty. With respect to expert report DCF-2016-2230-BIO, at folios 992 to 999, it stated that, as of 14 de noviembre del 2016, no geographic delimitation existed to determine whether the Nombre10 pier in Limón was located in a rural or urban area, and it was therefore impossible to answer the inquiry as to whether the pier was within the area declared to be the city of Limón. Regarding the geographical location of the homes of Nombre02 and Nombre01, it was stated that, with respect to Nombre15’s house, it was not determined whether it stood within the 50 metros measured from the high-tide line, nor was it marked within any public zone; likewise, in the case of Nombre01’s house, it was not determined whether it stood within the 50 metros measured from the high-tide line, nor was it marked within any public zone.

Report DCF-20017-583-BIO at folios 1052-157 is also challenged because it likewise failed to define the public-zone area. It is further disputed that the court questioned the legitimacy of the property registered in Nombre11’s name based solely on expert Nombre16’s statement that plans existed in connection with the processing of possessory title proceedings (información posesoria), but that none had been registered, whereas the defense argued that plano L—0057463, offered at folios 2441 to 2450, resulted in the registration of the property under real-property folio number in Nombre11’s name.

Furthermore, because expert witness (perito) ombre17 stated that he could not affirm whether the defendants’ house was within the area recorded by Dirección01 for Astorga’s property, whose northern boundaries extend to the high-tide line (pleamar), or within the area expropriated by ICODER, it was the duty of the Public Prosecutor’s Office to establish or rule out that circumstance. The court simply ruled out that possibility, contrary to the interests of the defense. It is also objected that Article 5 of the Ley de la Zona Marítima Terrestre indicates that the municipality may grant permits for the protection of persons and safety of navigation. It is claimed that the trial court failed to consider in its judgment regulation N-7841-P of law 6043, Article 22, concerning the powers of the administrative authorities. It was also argued that the trial court confused the finding of zero environmental damage (daño ambiental) made by SINAC in Portete with environmental impact (impacto ambiental), since environmental impact is the modification of the environment caused by human action or nature, whereas environmental damage is any action, omission, conduct, or act carried out by a natural or legal person, whether public or private, that alters, impairs, disrupts, diminishes, or places in imminent and significant danger any constituent element of the concept of the environment.

It is objected that the report indicated that there had been no environmental damage in terms of adverse effects resulting from changes in environmental and/or ecosystem services caused by the construction of the ombre10 pier; therefore, in counsel’s view, an economic valuation of the environmental damage was unwarranted. It is also claimed that this information was not assessed in the judgment and, accordingly, that ordering the demolition of the structures was improper. The failure to assess the documents submitted by the defense is criticized; according to the challenge, they were only briefly mentioned in the ruling without being evaluated in detail. Those documents included resolution 624-F2017 of the Tribunal Colegiado Agrario del II Circuito Judiciak de San José, which concluded that the provisions of law 6043 did not apply to ombre10 in connection with the land dispute in which the house of ombre03 and Icoder were within the land expropriated from Astorga, although Astorga asserted otherwise.

The defense also opposed the admission, as evidence to assist in reaching a decision (prueba para mejor resolver), of the expert report by Nombre18 IT 16025, which found in favor of Nombre19 and determined that the area was neither part of the maritime-terrestrial zone (zona marítimo terrestre) nor within the 50-meter strip measured from the high-tide line. It is reiterated that the conduct does not constitute an offense (conducta atípica), and the defendants’ acquittal is therefore requested on that ground, rather than through the application of an unavoidable mistake of law (error de prohibición invencible). Responses of the parties. The record reflects that, at folio 153 vuelto, the parties were given notice regarding the appeals filed by attorneys Álvaro Enrique Moreno Gómez and Juan José Picado Herrera, privately retained counsel for the accused Nombre01 and Nombre15, and that no response was filed.

Cross-appeal (recurso de apelación por adhesión) filed by attorney José Alejandro Alpízar Arrones on behalf of the Public Prosecutor’s Office. Challenge to the legal reasoning. It was claimed that the trial court erroneously applied a direct and unavoidable mistake of law (error de prohibición directo invencible) in favor of defendants Nombre01 and Nombre02, who alleged that they believed they had the right to continue living at the location, even though, in the appellant’s view, they clearly understood that the established conduct was prohibited. It is alleged that the court failed to analyze the fact that the accused knew that all beaches in Costa Rica are public, a circumstance that eliminates any possibility of invoking a mistake of law. It is stated that the evidence included the testimony of Nombre12, an officer of the Organismo de Investigación Judicial, who stated that the sea was clearly visible from the two defendants’ residence and indicated that he estimated the waterline to be no more than 50 meters from the residences.

In addition, the expert reports issued by the Laboratorio de Ciencias Forenses established that all the structures were within the 50-meter public zone (zona pública). The appellant considers it evident to both defendants that they were living on a beach, which is prohibited throughout the national territory without exception, since Costa Rica’s coastlines are said to have an inalienable 50-meter public zone. It is alleged that it is irrelevant whether the residence is located within a port city, because the exception mentioned in the Ley sobre la Zona Marítimo Terrestre refers solely to the absence of a restricted zone (zona restringida) within the cities listed in the law itself. That exception does not encompass the public zone, which will always be property in the public domain (bien de dominio público), intended for public use and enjoyment and for environmental conservation. It is also added that the witness Nombre13, a municipal official from Limón who asserted that he had extensive knowledge of matters concerning the maritime-terrestrial zone, stated that a public zone always exists, even in urban areas, regardless of the statutory exception.

Accordingly, it is alleged that if the public zone retains its legal status as part of the public domain regardless of its location, the defendants could not claim a mistake of law. It is also stated that section 70 of the Ley de Zona Marítima Terrestre provides that residents who have occupied the maritime-terrestrial zone since a date preceding the enactment of the law may continue occupying the area but must respect the public zone. In other words, private parties must leave the public-zone area unobstructed. It is asserted that this corresponds to the conduct adjudicated in the present case, but that, in the appellant’s view, the accused were nevertheless found to have acted under the belief that their conduct was not prohibited. It is argued that, from the moment they realized that the location was a beach, it was evident to both of them that they were occupying space that was public and intended for common use and that they therefore could not occupy it privately for their own purposes.

Additionally, opinions C-330-2020 and C-004-1980 of the Procuraduría General de la República are cited. Although they are not precedents binding upon the courts of justice, they may be considered in determining how the legal regime governing the public zone has been regulated administratively, since it was asserted that law 6043 ultimately imposed upon the municipalities the duty to administer that physical area and that the administrative precedents of the Procuraduría General de la República have defined how that strip of land is to be administered. It is requested that the judgment be vacated and that a retrial (juicio de reenvío) be ordered with respect to criminal liability. The appellant requests that the remaining matters decided in the judgment remain undisturbed because they are consistent with the law. First ground submitted by attorney Andrés Alfaro Ramírez on behalf of the Procuraduría General de la República.

Challenge to the legal reasoning. It is claimed that the court improperly applied the mistake-of-law doctrine by finding that the defendants did not clearly understand that the established conduct attributed to them throughout these proceedings was prohibited. It is claimed that the court failed to consider that a resident of the canton of Limón cannot allege ignorance of the legislation governing the beach located in the area, given that the residences occupied by the defendants were situated within the 50-meter public zone of the maritime-terrestrial zone. It is argued that all beaches in Costa Rica are public and that no one may reside in those areas because they are inalienable public-domain zones, which, in the appellant’s view, eliminates the possibility of any mistake. The testimony of witness Nombre12, an investigator with the Organismo de Investigación Judicial, is cited. He stated that the sea could be seen from the residence of Nombre02 and Nombre01 and that the ocean’s waterline was visible at a distance of less than 50 meters from the residences.

This was reinforced by the expert reports issued by the Laboratorio de Ciencias Forenses, which confirmed that all the structures, including those belonging to the defendants, were within the 50-meter public zone of the maritime-terrestrial zone. It is therefore disputed that the defendants could claim that they were unaware that they were living on the beach. It is also added that Costa Rica’s coastlines have an inalienable 50-meter public zone and that no exception of any kind exists in this regard, regardless of whether the area is located within a coastal city, since the exception mentioned in the Ley sobre la Zona Marítimo Terrestre refers solely to the absence of a restricted zone within the cities listed in the law itself. It is added that the exception concerning the existence of the restricted zone in coastal cities does not encompass the public zone, which will always be public-domain property intended for the use and enjoyment of any person and for environmental conservation; otherwise, structures would exist within the public zone of every coastal city in the country, which is impossible.

Accordingly, if the maritime-terrestrial zone retains its legal status as public-domain property regardless of its location, it is asserted that the accused did know that their conduct was unlawful. It is stated that section 70 of the Ley de la Zona Marítimo Terrestre provides that anyone having the status of a resident (poblador) on land or property within the maritime-terrestrial zone that they have occupied since a date preceding the enactment of the law may continue occupying the area, provided that the 50-meter public zone is respected. In other words, they may occupy the 150-meter restricted area, but not the public zone. It is requested that the judgment be vacated solely with respect to the application of a mistake of law. Response of the defense. Regarding the sole ground of the appeal filed by attorney José Alejandro Alpízar Arrones. At folio 170 vuelto, Álvaro Enrique Moreno Gómez, Master of Laws and privately retained counsel for defendant Nombre15, requests that both cross-appeals be denied.

It was asserted, first, that the judgment did not establish that the accused was living on a beach; living near the sea does not necessarily mean living on a beach. Furthermore, the fact that investigator Nombre12 stated that the sea could be seen from the two defendants’ residence does not mean that they were living on the beach. It is added that the witness, who was not an expert, indicated that he estimated the waterline to be less than 50 meters away; however, the accused ombre03 testified at trial that it was more than 50 meters away. It was also stated that, with respect to the 50-meter public zone established by the 2 challenged expert reports, neither demarcation (demarcación) began at the high-tide line, but rather farther inland. Therefore, neither of the two zones marked in the expert reports is accurate, as was argued and demonstrated in the appeal from the judgment. It is also stated that the legal concepts of beach and public zone are very different, while the Public Prosecutor’s Office is criticized for treating them as identical and confusing their use, as it did when it attempted to exclude the case file concerning SINAC-ACLAC-DR-0446-15 technical evidence, dated 23 de noviembre del 2015, which established that no environmental damage existed at ombre10, or when it falsely asserted during the trial that law 9577 had been declared unconstitutional.

It is also disputed that there are no exceptions for the public zone (zona pública), since Law 6043 so provides; otherwise, the Limón Courthouses and Hospital Tony Facio, built less than 50 meters from the water surface, would have to be demolished. It is alleged that there are parcels or properties (fincas) containing public-zone land within the maritime-terrestrial zone (zona marítima terrestre) that are still legally registered as private property and must be expropriated before they can pass into the public domain (dominio público). It is alleged that the prosecutor’s assertion is incorrect, because he failed to understand the scope of Law 6043 concerning the maritime-terrestrial zone and its regulations. It is argued that, from downtown Limón to Moín, there are hundreds of houses or structures built within the 50-meter public zone that are not illegal because they are located in the urban area of a coastal city.

It is further argued that the assertion that the accused (endilgado) knew his conduct was unlawful is a subjective assessment, not only because it was not proven at trial, but also because it was established that the defendants (justiciables) lived on a portion of land registered to a private individual since before 1977 and that had not yet been expropriated. With respect to the first ground of the appeal (recurso) filed by attorney Andrés Alfaro Ramírez on behalf of the Procuraduría General de la República, the defense stated that there was not a single piece of evidence establishing with precision that the home of the person he represented was located on the beach or within the 50-meter public zone. Once again, it was asserted that it could not be proven at trial that the defendant (encartado) was living or had lived on a beach, since the legal concepts of beach and public zone are very different.

It was also asserted that it is incorrect that Law 6043 contained no exceptions for the public zone. The arguments set forth under the preceding ground are reiterated, concluding with the assertion that considering that the accused (imputado) should have known that he was acting unlawfully is a subjective assessment by the appellant, given that it was proven at trial that the accused lived on a portion of land registered to a private individual since before 1977 and that had not yet been expropriated. It is requested that both appeals be denied.

III.The foregoing appeals must be granted, although for reasons partially different from those alleged. Having reviewed the arguments included in the judgment, this Chamber has detected a series of errors in the statement of reasons (fundamentación) that invalidate the arguments developed and prevent the decision under appeal from being affirmed. As may be seen at folios 35 and 36 of the judgment in the appellate record, the court explained that the issues in dispute were based on two main points: first, whether or not Nombre10 was part of the coastal city of Limón; and second, whether the defendants’ homes were located within the public zone (zona pública) of Portete. It is precisely in the determination of these two issues that defects in the statement of reasons were detected, as explained below. The first error concerns the arguments underlying the dismissal of the claim of defective procedural activity (actividad procesal defectuosa) due to the Ministerio Público and the Procuraduría General de la República lacking standing (legitimación activa).

Although that claim was properly dismissed as a matter of law, the arguments used to reject the defense theory that Playa Nombre10 was part of the coastal city of Limón—which the court repeated in its analysis on the merits—were improper and, given the essential nature of the issue under discussion, undermined the legality of the appealed judicial decision in its entirety. It was asserted that Playa Nombre10 is not located within the boundaries of the urban area of Limón, and the trial court, in support of that decision, stated the following: 1- Pursuant to the Ley de Creación y Organización del Instituto Geográfico Nacional (ING), specifically Article 1 thereof, the ING is the governing body for national cartography, responsible for preparing the official map and the geographical description of the Republic of Costa Rica; this is correct. 2- It was explained that the ING, through opinion number 222 of 2 de setiembre de 1980, issued by Nombre20, detailed the boundaries of the cities contemplated as exceptions to the application of the Ley sobre Zona Marítimo Terrestre.

The adjudicating body considered that official communication to have been issued to supplement the exception under Article 6 of law number 6043 concerning the protection of the maritime-terrestrial zone (zona marítimo terrestre), which provides that coastal cities are excluded from the provisions of that law; this Chamber does not share that view. The relevance of this issue lies in the fact that, if Nombre10 is part of the city of Limón, it would fall under the exception established in Article 6 of law 4063 Ley sobre la Zona Marítimo Terrestre, which exempts coastal cities from the provisions of that law. To resolve this point, it is necessary to examine law number 2906 of 24 de noviembre de 1961, entitled “Declaración Zona Recreo y Turismo Franja entre Nombre10 y 12 Millas de Limón,” Article 1 of which provides as follows: “The strip measuring 200 meters in width from the ordinary high-tide line, located within the maritime mile between the northern boundary of the urban area of the city of Limón, namely Portete, and the location known as ‘12 Millas’ or ‘Swamp Moth,’ north of the city of Limón, as well as the area extending 100 meters along both sides of the Río Moín in the section parallel to the beach, is hereby declared a recreation and tourism zone.

Twenty meters of that area shall be reserved for a scenic roadway in those locations where one does not currently exist. The remainder shall be transferred to the Instituto Costarricense de Turismo as part of its capital, and it shall administer it in accordance with the rules established by this law.” From its wording, it may be concluded that, by identifying Portete as the northern boundary of the urban area of the city of Limón, it did not specify whether those boundaries extended to Playa Portete and included or excluded it. Subsequently, law number 4366 of 1969, concerning the Administrative Territorial Division (División Territorial Administrativa) of the city of Limón, provided in Article 8 that the provinces of Costa Rica are divided into cantons, expressly stating in that provision that the province of Limón is divided into the cantons of Limón, Pococí, Siquirres, Talamanca ( Ley 4339 de febrero de 1970), Matina ( Ley 4344 del 24 de junio de 1969), and Guácimo, the latter created by law 4753 of 3 de mayo de 1971.

Subsequently, Decreto Ejecutivo número 21515-6 del 10 de agosto a 1992 recognized the authority of the Instituto Geográfico Nacional to rule on the boundaries and numbering of districts, while Decreto Ejecutivo número 21720-6 publicado en la Gaceta número 239 del 14 de febrero de 1992 identified Limón, Valle de Estrella, Río Blanco, and Matina as cantons of the province of Limón. Article 10 of law number 4366 of 1969 provided in its second paragraph that divisions between cantons must follow natural boundaries and that geodesic straight lines shall be designated only when this is not possible. The third paragraph states that, when the separation between cantons includes non-natural geodesic straight lines, the adjoining cantons shall finance the placement of boundary markers (amojonamiento), which shall be carried out by the Instituto Geográfico Nacional. All of this supports the understanding that changes to the boundaries of provinces and cantons must be made by law, although this does not apply to districts.

That law also grants authority to the ING for this function, as does the Ley de Creación y Organización del Instituto Geográfico Nacional, law number 59 of 4 de julio de 1944, which designates it as the official entity for cartographic, geographic, and geodetic matters. Thus, the Instituto Geográfico Nacional is the entity responsible for placing boundary markers throughout the national territory, as it is also responsible for preparing provincial and cantonal maps, which must be revised when appropriate. Accordingly, the court’s reasoning in that regard was correct. The problem is that, although the Instituto Geográfico Nacional is the entity competent to issue the administrative act (acto administrativo)—namely, official communication or opinion number 222 issued on 2 de setiembre de 1980—the court failed to identify in its judgment the folio at which that document appears; nor was the document itself admitted into documentary evidence (prueba documental), and standing alone it is not enforceable against third parties (oponible a terceros).

Although the court below did not specify this, it may be inferred that the information concerning the existence of that official communication was taken from the copy of the Technical Report issued by the Director of the IGN, Max Lobo Hernández, which forms part of the copies of the documents admitted and incorporated from file 19.783 of the Asamblea Legislativa, entitled: “Investigación sobre las circunstancias en torno a la construcción de un muelle privado en Bahía Portete, en el cantón central de Limón.” The court stated that this report appeared beginning at folio 935 and analyzed it at folio 43 of the judgment, where it again cited the existence of the aforementioned official communication but added that the opinion had been communicated to the Director de Catastro Nacional, thereby establishing the boundaries of the city of Limón and specifying that the demarcation in that sector was digitally georeferenced.

This internal administrative act provided the Catastro Nacional with information regarding the coastal boundaries of the city of Limón, but it did not provide such information to the rest of the Costa Rican population because, under Articles numbers 120, 121, 122, and 123 of the Ley General de la Administración Pública, that administrative act had to be published in the official gazette before it could have effect against third parties. Provision 120 states: “For purposes of classification and legal effect, acts of the Administration are classified as external or internal, depending on whether or not they are directed to the governed party; and as specific or general, depending on whether or not they are directed to an identified person...” Article 121 of that law literally provides: “1. Acts shall be called decrees when they are of general scope and agreements when they are specific. 2.

Decrees of a regulatory nature shall also be called regulations or regulatory decrees. 3. Agreements deciding an administrative appeal or claim shall be called decisions.” Article 122 establishes that internal acts shall have no effect under the State’s general legal system to the detriment of a private party, although they may operate for that party’s benefit. In other words, for an administrative act to be enforceable against third parties, it must have been published by means of an executive decree in La Gaceta as the Judicial Gazette or, alternatively, for it to be specifically enforceable against the defendants, it must be shown that they were duly notified of it, which the judgment did not indicate. Otherwise, the administrative act lacks legal effect under the legal system, and the court therefore could not rely on official communication number 222 to conclude that the defendants were not protected by Article 6 of law number 6043 concerning the maritime-terrestrial zone merely because that official communication so provided.

This does not mean that the opinion was not duly published; if it was, however, the judicial authorities must base their decisions on the relevant Executive Decree or official notice and apply the corresponding provisions. Curiously, the only Decreto Ejecutivo número 36642-MP-MOPT-MINAE referenced in the judgment is the one establishing in Article 20 that digitally georeferenced demarcation applies in those sectors of the maritime-terrestrial zone where there is no demarcation by physical boundary markers. Nevertheless, it bears repeating that the issue is not whether the Instituto Geográfico Nacional is the entity authorized to establish coordinates and place boundary markers, including virtually; rather, the objection is that, for the administrative act relied upon as the basis of the challenged decision to have general effect, it must be duly published in the official gazette. This is also established in Article 63 of Reglamento número 7841-P de la Ley sobre Zona Marítimo Terrestre, which states verbatim: “The Instituto Geográfico Nacional shall publish notices in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.” The trial court made no reference to this fact, and it is conspicuously absent from the statement of reasons for the judgment.

It is clear that, once the physical—as opposed to virtual—placement of boundary markers in Portete had been completed, the notice or official communication establishing the boundaries of the city of Limón in accordance with the physical boundary markers placed up to that time was published in the official gazette La Gaceta in noviembre del año 2015. This, however, does not cure the defect concerning official communication number 222 regarding the virtual placement of boundary markers in 1980, which the court used to conclude that, since 1980, the boundaries of the city of Limón and the exclusion of Nombre10 from the aforementioned urban area had been legally established. Regarding the right to appeal the administrative act, jurist Manrique Lara has stated the following: “The persons entitled to file this appeal are the holders of legitimate interests and individual rights. Logically, persons holding a right that may be affected by the decision also have standing, which requires them to enter an appearance in the proceeding in order to exercise the right to appeal before the same body that issued the challenged act.” (Nombre21. “La Legitimación Administrativa”, 5ta edición, San José, página 72, 1991).

That is, the requirement that an administrative act (acto administrativo) be published in order to have general applicability, or that the decision be duly served on the persons subject to the Administration (administrados), is intended first to ensure compliance with the right to be informed, thereby allowing them to exercise control over it by challenging it when it is deemed abusive or detrimental to their interests and, upon being informed of it, to challenge that act through the previously established procedure. If the administrative act is not published, the person subject to the Administration is prevented from learning of it; consequently, it may neither be asserted nor enforced against that person, nor is it valid. Regarding the scope of an administrative act, the Constitutional Chamber has consistently upheld in its case law the criterion previously described, for example, in resolution 11924-2008 del 30 de julio del 2008, in which it stated that an executive decree is, as a general rule, of general applicability and need not be personally served, since publication alone is required, after which it may be asserted against third parties.

Regarding this issue, the First Chamber of the Supreme Court of Justice explains that the sanction applicable to an administrative act that fails to comply with the legally established procedure is its invalidity, as may be seen from the following excerpt from resolutions numbers 1242-2020 del 31 de marzo del año 2020 and 254-F-S1-2011 de las 9 horas 25 minutos del 10 de marzo de 2011, which states: “(…) an act is conceived as a unilateral declaration of intent, knowledge, or judgment made by Public Administrations in the exercise of the administrative function, which directly or indirectly produces specific or general legal effects, whether regulatory in nature or otherwise, through the exercise of their powers. It is deemed valid insofar as it is consistent with the legal system (artículo 128 LGAP). It is also required that it be issued by the competent body or entity and that all legally mandated requirements and procedures be fulfilled (numeral 129 ibídem).

The latter are classified into two groups: formal and substantive. The former concern the exercise of the power authorizing the public action and consist of the procedure, the form (the manner in which it is manifested), and the decision-maker (competence). The substantive requirements, by contrast, relate to the purpose of the act and define the activity that the Administration seeks to carry out; they consist of the grounds, content, and purpose (…)”. It is therefore vitally important to verify that the official communication cited in the judgment was duly published, as required by the legislation already cited. Regarding IGN pronouncement 222, as an administrative act, the judgment under appeal included the following reasoning as grounds for validating that administrative act and asserting it against the defendants. On page 9 of the appeal record, the judgment stated, as its first argument, that IGN was the entity authorized to establish the coordinates of coastal cities, either virtually or physically, through a pronouncement or notice, which is true.

However, as its second argument, it stated verbatim: “Second, there is no way to substantiate Lic. Nombre14’s assertion that the administrative act through which IGN communicated the coordinates of the boundary of the city of Limón reflects solely the subjective will of the director of IGN. It is that assertion by the defense that is entirely a subjective assessment. It is clear that administrative acts are preceded by preparatory acts and supporting materials that lead to their adoption. The fact that the preparatory acts or supporting materials on which it was based were not offered as evidence in this trial does not mean that they do not exist or that the establishment of those coordinates was merely arbitrary and unfounded; that is an assumption made by Lic. Nombre14, and it is unsupported by any item of evidence.” Although the defense argument was not properly presented, the reasoning of the court below (a quo) is untenable because it is the judicial authority that is asserting the administrative act against third parties—in this case, the defendants, as residents of Portete—and not the other way around.

Accordingly, it is the judicial authority that must ascertain the standing of the administrative act used within the legal system. What is being questioned is not the existence of the administrative act or IGN’s authority to issue it, but whether it was merely an internal act, which, as already explained, could not be asserted against third parties. The adjudicator should therefore have relied on the 1980 Executive Decree arising from the aforementioned pronouncement, if that decree or official notice existed; otherwise, the adjudicator could not attribute to that administrative act a coercive force that it does not possess. As a third argument for rejecting the claim of defective procedural activity (actividad procesal defectuosa) raised by attorney Alvaro Enrique Moreno, the judgment stated verbatim: “Third, if Lic. Nombre14 or the defense considered that administrative act arbitrary and believed that it adversely affected them, they should have challenged the act before the appropriate jurisdiction, namely, the Administrative Litigation jurisdiction (Contenciosa Administrativa), where the background of the act could have been examined and its annulment potentially obtained.

However, that was not done and, consequently, there is no reason whatsoever for this authority even to consider that there might be anything improper about it. The court below is also incorrect, because it was the judicial authority that was required to ascertain whether official communication number 222, pursuant to the provisions of the General Law of Public Administration (Ley General de la Administración Pública), could serve as the basis for its arguments and whether those arguments were valid. Specifically, the judicial authority should have ensured that the pronouncement issued by the director of IGN in 1980 had been lawfully published in compliance with the procedure established by law; alternatively, it should have been duly served on the defendants as a decision, so that it could be presumed that the accused, as persons subject to the Administration, did not appeal that administrative act.

It should not have inferred what is legally unknown and nevertheless presented it as a valid argument against the persons standing trial. In its fourth argument, the court found that, because that pronouncement had been issued as a supplement to Ley 6043 de 1977 concerning the maritime-terrestrial zone (zona marítimo terrestre), and because the official communication had been issued only 3 years later, it could be inferred that the act was adopted to give effect to the exception set forth in artículo 6 de la ley 6043 cited above. Thus, it was not an act issued at the time of these proceedings—that is, in 2015—such that it could be assumed to have been issued solely to harm the accused by unexpectedly demarcating the extent of the coastal city of Limón. On page 10 of the appeal record, the court stated verbatim: “(…) This in turn means that the defense had sufficient time to challenge that act, given that these proceedings began in 2015 and the trial was not held until 2021.” In so finding, it disregarded the provisions of the General Law of Public Administration, which establishes in artículo 122 that decisions, as internal acts, may be invoked by a person subject to the Administration for that person’s benefit but may not be asserted to that person’s detriment.

This raises doubt as to whether, prior to 2015—when a second official communication was issued that, as already indicated, was duly published in November 2015 by executive decree and thereby became valid—there was an administrative act of general applicability that would support the assertion that it supplemented the aforementioned 1961 Law with respect to whether Nombre10 was located within the city of Limón. Depending on that determination, the trial court may conclude either that the alleged conduct was not criminally proscribed (atípica), as the defense contends, or, conversely, that the conduct may have been criminally proscribed (típica) and unlawful (antijurídica), but not culpable, given the possible existence of an unavoidable mistake of law (error de prohibición invencible), an issue that will also be revisited below. Regarding the general applicability of IGN official communication number 222 and its implications for the criminal proceedings, it should also be noted that, as the trial court stated, report DCF 2015-1247-ING, de agosto 2015, on page 536 et seq., based its conclusions on the coordinates contained in the same official communication cited above.

As its fifth argument, the court rejected the claim that city boundaries may be established only by statute. The defense is indeed incorrect, for the reasons set forth above, regarding the delimitation of districts and the entities empowered to perform it. The point of disagreement with the decision-making body, however, is its conclusion that the 1961 Law, which established a strip measuring 200 meters from the high-tide line (pleamar), from Nombre10 to the place known as 12 millas, and included both tracts within the urban area of the city of Limón, did not apply to Playa de Portete, much less to the exception in artículo 6 of that same law. In the decision-making body’s view, the defense misread the cited law because, although the law identifies Nombre10 as a boundary of the city of Limón, that does not mean that it places it within the exception contemplated in artículo 6 de la Ley 6043, which is, moreover, a later statute.

According to the trial court, on page 10 of the appeal record, the aforementioned artículo 6 states verbatim: “(…) The provisions of this law shall not apply to areas of cities located along the coasts, or to coastal urban zones…” and ley 2906 states that Portete is the northern boundary of the urban area of the city of Limón. This means that the statutes use different terms, which, in the trial court’s view, precludes the interpretation advanced by the defense, particularly because the 1961 Law was not drafted to establish an exception created by a later law. That view is mistaken because, regardless of whether one law predates the exception created afterward, nothing prevents one from supplementing the other, even if they do not use precisely the same terms, provided that the essential meaning of their provisions is understood, as is apparent from simply reading them. Nor is the argument made in the judgment—that a Legislative Assembly Committee examining the illegality of the construction of a pier in Portete concluded that Nombre10 was not part of the city of Limón—relevant to what must be proven in criminal matters, because, for the case at bar (subjudice), it is not the Legislative Assembly but the trial court that must determine that issue.

Where the adjudicatory body is correct is that, irrespective of the foregoing, it is immaterial whether the Municipal Council is responsible for administering those lands for purposes of finding that both the Public Prosecutor’s Office and the Office of the Attorney General of the Republic have standing to bring an action in these proceedings: the former because it has exclusive authority to bring criminal prosecutions, as established in section 16 of the Code of Criminal Procedure (Código Procesal Penal), and the latter because it represents the interests of the State and defends the national patrimony, as established in article 3 of the Organic Law of the Office of the Attorney General of the Republic (Ley Orgánica de la Procuraduría General de la República). Thus, the defect arose from the arguments used to reject the position that Nombre10 fell within the exception provided for in article 6 of ley 6043, considering that the judgment did not explain whether the persons subject to the administrative action (administrados) had legally had an opportunity to appeal the official communication on which the principal arguments were based, either because it had been duly published through the appropriate channel or because it had been served on the defendants, such that its administrative effects could be asserted against them and used in the criminal proceedings to rebut the defense theory that the previously explained exception applied.

With respect to the use of that official communication to determine whether the structures built in Nombre10 were located within the restricted area or the public area, the forensic expert report prepared by expert Nombre14, number DFC 201-746-ING, at folio 220, and supplemental report 2015-1247-ING, at page 536, show that the expert stated at folio 21 of the appellate record: “(…) if my memory does not fail me, the report itself indicates that the entity responsible for setting boundary markers (amojonamiento) for the ING sector was consulted; they told me that at the time there were no boundary markers, either physical or digital. That information was recorded and appears in the expert report. I placed the boundary between the public and restricted zones because, for the second report, the registry, through IGN, issued a notice and established digital boundary markers in that sector; an information request was made, and we were able to obtain that digital boundary line, which is identified in that supplemental report or clarification…” From the expert’s testimony, we may infer that the reports determining that the residences were located partly in the restricted area and partly in the public zone relied on coordinates derived from an administrative act (acto administrativo) that the case file does not show to have been officially promulgated and as to which the record likewise does not establish whether the persons subject to the administrative action were afforded due process (debido proceso), whether through publication of the act or through service of the corresponding notice on the parties, which would have enabled the accused to challenge it if they considered that the administrative decision harmed their interests.

Hence the importance of verifying the validity of that administrative act in a new trial following remand (juicio de reenvío). The second defect in the statement of reasons (fundamentación) concerns the arguments as to whether the specific structures possessed by the defendants are located within the restricted zone or area, the public zone, or the beach. The lack of precision on this issue in the reasoning of the judgment directly affects the second pillar of the challenged decision. Analysis of the judgment revealed a lack of specificity on the matter because, although it stated that the structures belonging to both defendants were located on public-domain property (bienes de dominio público), that conclusion was not properly reasoned. First, at folio 36, the court analyzed the testimony of the officer from the Organismo de Investigación Judicial, an account that assumes particular significance given that, according to expert Nombre14’s testimony, he did not know who lived in the structures at Playa Portete; rather, it was officer Nombre12 who provided the information identifying the persons who possessed the structures built there, including the residences occupied by the two defendants, regarding which the witness stated at folio 28 of the appellate record: “The houses of Nombre03 and Nombre01 do not border the sea; the sea can be seen from them…” This statement contradicts the assertion by the Public Prosecutor’s Office and the Office of the Attorney General of the Republic that the structures possessed by the accused and private defendants (querellados) were built on the surface of the sea or on the beach.

Regarding the location of the residences within the maritime-terrestrial zone (zona marítimo terrestre), the court asserted that the accused persons’ residences were within the public zone and, in support of that finding, cited expert report 2015-1247-ING, at folio 536, as one of the supplemental reports arising from report 2015-746-IGN, which the court described at folio 36 of the judgment as follows: “It shows the location of each of the seven structures identified in the accusatory pleadings and the civil action in this case, including the pier, warehouses, offices, and small houses described by Nombre12. Specifically, page 538 contains a map of the Portete area on which each of the seven structures is marked; the maritime-terrestrial zone is also delineated, including both the 50 meters of the public area and the 150 meters of the restricted area, making it clear that some of the referenced structures are within the public zone and others are on the surface of the water, exactly as Nombre12 and the expert himself stated.” From the quoted passage, it was concluded that the court described the contents of the report in general terms but did not specifically analyze it in relation to the circumstances of the two defendants because, although other structures exist at that location, the relevant ones are the residences of Nombre03 and Lindo.

A judgment is a legal instrument that must stand on its own; merely identifying the evidence relied upon is insufficient, and the decision must include the analysis that enabled the court to reach a particular conclusion. In the specific case of both accused persons, the court failed to indicate where their residences were situated on the maps included in each cited report or their specific distance from the high-tide line (pleamar), even though this is the central issue in the accusation. Based on that analysis, the court should then have concluded whether the residences were in the public zone, the restricted zone, or both. As written, the judgment permits only the inference that some of the seven structures at Playa Portete were in the restricted zone and others in the public zone, without providing any further specific details concerning the defendants’ structures; furthermore, the court should have cited where the stated information appears in each report, information that was omitted from the judgment.

That defect is aggravated by the fact that, as the court assessed at the end of folio 36 of the appellate record, the expert had no personal knowledge of who possessed each structure; that information was instead provided by judicial investigator Nombre12. The court went to great lengths to explain the judicial officer’s good faith and concern regarding the accused persons, without explaining in detail what information the witness specifically provided about the accused persons’ residences, as opposed to the structures generally. It does not state with certainty how far each house was from the surface of the sea or the high-tide line. The court insisted that the officer’s information concerning the location of each structure and its occupants could not be doubted, without indicating the precise location and placement of the structures to which it was referring. Subsequently, at folio 37 of the appellate record, a series of documents issued by the Municipalidad de Limón was cited to conclude that no type of permit had been granted in the area.

The court deemed this particularly significant because officer Nombre12 had stated that some of the structures investigated—without specifying exactly which ones—were located in the sea or on the surface of the sea, yet it did not explain how that information related to the specific case of the two defendants. This is particularly important given that, at trial, the judicial officer referred to all the structures built in the Portete area and even described a pier and warehouses, structures that, according to the explanation in the judgment, would in principle have no connection to the accused persons but instead belonged to defendants against whom the present case was dismissed (sobreseídos). The court therefore failed to explain how that analysis related to defendants Nombre03 and Nombre01. At folio 36 of the appellate record, the court continued by analyzing whether the pier built in Portete lacked any permit for either its construction or its use, without explaining what relationship that structure had to the defendants’ residences—a relationship that apparently did not exist.

Although this appellate chamber is analyzing only those arguments through which the location of the two residences within the public zone was established, it is evident that the judgment continuously referred generally to all the “structures,” without specifying, in most instances, the particular location and circumstances of the residences of Nombre03 and Nombre01. This omission is especially significant because the sketches in each expert report in the case file identify the structures by number; in other words, the sketch or report was not intended solely to analyze the circumstances of the accused persons’ residences, but those of all the structures in the Portete area, which made it all the more incumbent on the trial court to include the analysis already described in its decision. These expert assessments were revisited in the evidentiary analysis beginning at folio 39 of the appellate record, where the court repeated the same error by describing each expert assessment and its supplemental reports, beginning again with expert assessment DCF:2015-1247-ING, at folio 536.

That report stated that it had been possible to delineate the restricted zone from the public zone and mentioned the map or sketch at folio 538, which was described as depicting all seven structures. The court again explained that the structures under examination were located partly within the public zone and partly on the high-tide line, without specifying or detailing the distance between the two defendants’ residences and the high-tide line, even though those matters had to be clearly set forth in the judgment in order to substantiate the acts with which they were charged. This error was repeated at folio 40, where the court analyzed the remaining expert assessments and explained that the difference between the previously mentioned report and DCF:2017-682-ING was that engineer Nombre14 had made an error in the reference points. The adjudicatory body stated that the expert acknowledged this error during the trial and that, in this latter report, the structures appeared within the high-tide area, whereas the correct finding should have been that set forth in report DCF: 2015-147-ING, which concluded that the structures were within the public zone and the maritime-terrestrial zone.

However, the court did not specify whether what had been identified as the property possessed by each defendant was entirely built upon or whether only part of the lot was built upon. Nor did it clarify whether the property was in the public zone and the house in the restricted area, or vice versa, or whether the structure lay across both zones, because none of those matters was analyzed or explained in the challenged decision, thereby creating a defect in the statement of reasons.

The expert report (dictamen) DCF:2016-2230-BIO at folio 992 was then described at folio 40 of the appellate record (legajo de apelación); it was noted that the report contained photographs of the structures under investigation and a map of the area, without the court once again analyzing or at least describing the exact location of the dwelling houses (casas de habitación). Regarding expert report DCF: 2017-00583-BIO, it was explained that it appeared at folio 1052, but once again it was not analyzed in detail; it was merely stated that neither report provided further information relevant to deciding the case. It should be noted that although the trial court must rely on the expert reports and other evidence in the case file, it is not the expert who determines the existence of a possible offense, but the trial court. Thus, it is not enough for the engineer to classify a particular structure as being located in the public zone (zona pública); rather, the court must analyze those expert reports in detail, especially when all of them were admitted at trial and also used by the parties when questioning the expert.

Such an assessment is necessary in order to find that the alleged unlawful conduct was established with respect to each dwelling house separately, without making generic references. If an expert report is not specific, the court must explain the supplementary evidence on which it based its certainty that the accused occupied houses within the public zone and that their houses were located less than 50 meters from the high-tide line (pleamar), so that the court itself determines whether the alleged offense exists. This requires not only a description of the evidence, but also an analysis of each item of evidence submitted for its consideration and on which it relied in reaching a particular conclusion. It is unacceptable that the entire judgment failed to include the specific location of each structure at Playa de Portete and the distance of each one from the high-tide line. Indeed, although the judicial investigator did not refer specifically to any of the seven structures, he did explain that some of them were in the sea, or in what the witness called the water surface (espejo de agua), and that the defendants’ dwelling houses were not in the sea, although the sea could be seen from them.

It must be clarified that what is challenged at this stage is not the possibility of using virtual boundary monumentation (amojonamiento virtual) to determine the coordinates defining the boundary of the city of Limón—which, as legally discussed above, the Instituto Geográfico Nacional is authorized to do—but rather the failure to publish the notice, which prevents that administrative act (acto administrativo) from being enforceable against third parties, namely the accused. According to the judgment’s own analysis, publication did occur with official communication 2015-11, which published the boundaries of the city of Limón, even after physical boundary monumentation (amojonamiento físico) had been performed. That administrative act was published as stated at folio 723 in the report sent to the Asamblea Legislativa by Director Max Lobo, which indicated that the delimitation of Portete was published through notice 2015-11, published in La Gaceta number 222 of 16 de noviembre de 2015, concerning “Delimitation of the Public Zone of the Maritime-Terrestrial Zone in Bahía Portete, from the Boundary of the City of Limón at Nombre10, following the river westward to boundary marker 500 of Limón” (“Delimitación de la Zona Pública de la Zona Marítimo Terrestre en Bahía Portete, desde el Límite de la Ciudad de Limón en Nombre10 siguiendo río oeste hasta el mojón 500- de Limón”).

That boundary monumentation was performed while the present facts were under investigation. This official notice was published in noviembre del 2015, by which time the occupants of the structures at Nombre10 were no longer living in them because they had been evicted from the site pursuant to a precautionary measure (medida cautelar) which, according to the charging document itself in the second alleged fact, was ordered by the Juzgado Penal de Limón in agosto del 2015, when the buildings were placed in the custody of the Servicio Nacional de Guardacostas. All of this should have been analyzed in the judgment in relation to the date on which notice number 222 of setiembre de 1980 was duly published in the official gazette, rather than, as the decision did, by reference to the date on which the notice was created, as analyzed in the judgment. Regarding the reasoning supporting the existence of a mistake of law (error de prohibición): the two factual scenarios presented in relation to the ING communication from 1980 would lead to very different conclusions.

If no administrative act of general scope (acto administrativo de alcance general) had been issued before 2015, the defendants’ conduct would not constitute an offense (atípica), because the only legal reference concerning the possible inclusion of Nombre10 within the city of Limón would be the already cited Law of 1961. Conversely, if the 1980 determination had been made official through publication in the official gazette, the conduct would satisfy the statutory elements of the offense (típica) and be unlawful (antijurídica), but would not necessarily be culpable (culpable). In addition to the arguments cited by the court, it must be considered that, as stated in the judgment, expert report DCF: 2015-746, at folio 220, dated mayo del 2015, made clear that the maritime-terrestrial zone (zona marítimo terrestre) could not be delineated at that time because the IGN reported that there was no physical boundary monumentation in the area.

That situation was subsequently corrected, to the extent that in noviembre del año 2015 notice 2015-11 was made official, specifying the boundaries of the city of Limón and excluding Portete. This creates the dilemma that, even assuming that the virtual boundary monumentation performed in 1980 had been published in the official gazette, there was no physical boundary monumentation in the Portete area. It was therefore not feasible for the accused to know that they were violating the provisions of Ley 4063, because, since Nombre10 was not part of the city of Limón, the provisions governing the maritime-terrestrial zone would apply to the land in the area where their dwelling houses were located. Regarding the arguments of the Ministerio Público and the Procuraduría General de la República that the defendants could not be deemed to have acted under an unavoidable mistake of law (error de prohibición invencible) because, even if they believed that Article 6 protected them on the understanding that Nombre10 lay within the boundaries of the city of Limón, they argue that the evidence showed the structures to be located on the beach.

It is argued that Costa Rican coastlines have an inalienable public zone of 50 meters, regardless of whether it is located in a port city, because, in their view, the exception in Article 6 of Law 6043 refers solely to the absence of the restricted zone (zona restringida) in the cities listed in the law itself. Although no legal provision is cited in support, the Ministerio Público bases its assertion on the testimony of the witness Nombre13, a municipal official who serves as an inspector of the maritime-terrestrial zone—whom the appellant regarded as an expert on the subject—while the representative of the Procuraduría General de la República relies on the testimony of officer Nombre12. As both appellants state, Article 70 of the Maritime-Terrestrial Zone Law (Ley de Zona Marítimo Terrestre) provides that persons who occupied territories that are now within the maritime-terrestrial zone and who had occupied land for 10 years, which after the enactment of the law became land deemed part of the maritime-terrestrial zone, may remain in possession of their respective lots and must respect the public zone.

However, the assertion made by both appellants cannot be derived from the content of that provision. First, the article very clearly refers to land that would be considered part of the maritime-terrestrial zone after the law was enacted; that is, it does not refer to properties within coastal cities, particularly because Article 6 of that same law states verbatim: “The provisions of this law shall not apply to areas of cities located on the coasts, coastal urban zones (zonas urbanas litorales), properties lawfully registered in the names of private parties, or properties whose legitimacy is recognized by law.” (“Las disposiciones de esta ley no se aplicarán a las áreas de las ciudades situadas en los litorales, ni a las zonas urbanas litorales, ni a las propiedades inscritas, con sujeción a la ley, a nombre de particulares, ni aquellas cuya legitimidad reconozcan las leyes.”) (As amended by the Framework Law for the Declaration of Coastal Urban Zones and Their Territorial Use and Development Regime (Ley Marco para la declaratoria de zona urbana litoral y su régimen de uso y aprovechamiento territorial), number 9221 of 27 de marzo del 2014).

This means that none of the provisions established in that law apply to land within coastal cities such as Limón. Furthermore, in this specific case it would be necessary to analyze the provisions of Article 8 of Ley 2121 of 27 de marzo del 2014, Ley Marco para la Declaratoria de Zona Urbana Litoral, which states that concessions (concesiones) may be granted within coastal urban zones in accordance with that law and the urban regulatory plan (plan regulador urbano) of the respective locality. The second, third, and fourth paragraphs of that provision state verbatim: “Excluded from the provisions of the preceding paragraph are land comprising open spaces for common use, land enabling free access to the coast, land subject to the State’s natural heritage regime, land not belonging to the public domain, and land located within the 50 meters adjoining the ordinary high-tide line that was not occupied before this law entered into force. —Concessions granted within the 50 meters adjoining the ordinary high-tide line shall be subject to the condition that neither the use nor the building density existing on the land before this law entered into force is modified or increased, provided that such conditions have been endorsed by the urban regulatory plan and do not violate current environmental regulations.

Municipalities whose jurisdiction includes coastal urban zones shall guarantee free access to the coast and enjoyment of the beach for the entire population, without prejudice to the work performed by other State institutions for that purpose.” (“Quedan excluidos, de lo dispuesto en el párrafo anterior, los terrenos que se presenten espacios abiertos de uso común, aquellos que posibiliten el libre acceso a la costa, aquellos afectos a un régimen de patrimonio natural del Estado, aquellos que no correspondan al demanio público y aquellos ubicados en los 50 metros contiguos a la pleamar ordinaria que no hayan sido objeto de ocupación antes de la entrada en vigencia de esta ley. -Las concesiones que se otorguen en los 50 metros contiguos a la pleamar ordinaria estarán condicionadas a que no se modifique el uso ni se amplíe la densidad de la construcción que tenía el terreno antes de la entrada en vigencia de esta ley, siempre y cuando tales condiciones hayan sido avaladas por el plan regulador urbano y no incumplan la normativa ambiental vigente.

Los municipios cuya jurisdicción incorpore zonas urbanas litorales deberán garantizar el libre acceso a la costa y el disfrute de la playa a toda la población. Sin perjuicio de las labores que ejecuten otras instituciones del Estado para dicho propósito”). This article supports the conclusion that it is not true that the 50 meters from the high-tide line must invariably be respected within coastal cities. Instead, in such cases each municipality will review the concession allowing a structure predating the Law of 2014 to remain within the public zone comprising the 50 meters from the high-tide line, except in the circumstances specified in the cited provision. According to the testimony given at trial by officer Nombre12, which was also cited by the appellants, although there may be houses on the sea surface at Nombre10, the defendants’ houses were not in such a situation, nor were they on the beach.

Nevertheless, the reasoning of the judgment makes it impossible to reach that conclusion because it provided no grounds on that point. Since the judgment did not specify the distance at which the defendants’ dwelling houses—as opposed to the other structures—were located, it is impossible to determine from the court’s considerations whether the accused’s dwelling houses, which the judgment found to be located within the public zone, were situated, or whether at least one of them was situated, specifically on the sea surface or on the beach. This issue would be relevant to determining whether there was an unavoidable mistake of law, once the possibility that the conduct did not constitute an offense had been ruled out under the criteria outlined above, all in accordance with Article 8 of the aforementioned Law 9221, which, depending on the circumstances, permits the use of buildings and dwellings within the public zone of coastal cities.

Even though the arguments used to apply an unavoidable mistake of law (error de prohibición invencible) were initially valid, this does not permit disregarding the aforementioned defects, which require the judgment to be declared ineffective, since the effects of an acquittal (absolutoria) based on lack of statutory definition as an offense (atipicidad) or on an unavoidable mistake of law have different civil consequences, which also requires declaring ineffective the ruling concerning the judgment’s civil consequences. Regarding the participation of civilly interested third parties (terceros civilmente interesados). At the intermediate stage (etapa intermedia), some defendants (imputados) were dismissed from the case (sobreseídos); however, based on a reading of the Order Committing the Case to Trial (Auto de Elevación a Juicio), those persons could be considered civilly interested third parties, because the criminal judge, by means of the ruling dated 20 de mayo del 2019, entered in the electronic case file (expediente virtual) at 14:49:79, maintained in effect the precautionary measure (medida cautelar) ordering the eviction of all existing structures in Portete, a measure that, according to the indictment (acusación), was carried out in agosto del año 2015.

Therefore, pursuant to Articles 121 and 124 of the Code of Criminal Procedure (Códdigo Procesal Penal), and upon new proceedings (nueva sustanciación), the civilly interested third parties may request leave to participate at the trial stage (etapa de juicio), because it was in the Order Committing the Case to Trial that the previously ordered precautionary measure was maintained in effect, and that ruling gave rise to their right and their connection to the proceedings. They may, of course, petition to be legally recognized in the criminal proceedings as civilly interested third parties and, in that capacity, participate in the proceedings. This position is endorsed by the Sala Constitucional in rulings numbers 5447, issued at 16:57 on 4 de octubre de 1995, and, to the same effect, vote No. 4121, issued at 16:51 on 13 de agosto de 1996, which held that civilly interested third parties may submit evidence and be heard during the trial.

This has been recognized in addressing the issue of forfeiture (comiso) and its impact on third-party owners, considerations that apply equally to the case under review, since the aforementioned ruling number 5447 stated: “Once judgment has been rendered, if it orders forfeiture, it must be understood that third-party owners or possessors of the property who did not participate in the offense adjudicated and who could be affected by the measure were afforded an opportunity to defend themselves and be heard, in accordance with the cited articles. Although those articles do not expressly provide for a specific procedure for giving notice to or allowing the appearance (apersonamiento) of a third party, by mandate of the Political Constitution itself and the fundamental principles underlying it, set forth primarily in Articles 39 and 41(...), the adjudicator must, insofar as possible, use the available procedural mechanisms to devise a means of providing that prior hearing to any third party who may be affected, since it would be inconceivable for a dispossession to operate by operation of law, or for a decision to affect a person’s rights or legitimate interests, without that person even having been heard, particularly when the person’s property is exposed to a diminution that would occur almost by operation of law through automatic application of the provisions concerning forfeiture and confiscation, a practice incompatible with the aforementioned fundamental rights of defense and to a hearing.

Even though civilly interested third parties may resort to civil proceedings not only to assert their rights but also, above all, where possible, to claim compensation for any harm caused, constitutional case law has held that, where such civil third parties may be deprived of any possessory right, they are entitled to participate in the criminal proceedings. This would apply in the present case, in which the judgment could even order the permanent destruction of the buildings to which they claim rights, depending on the outcome of the proceedings. Based on the foregoing, the judgment is declared ineffective, and the case file is remanded (reenvío) to the court of origin so that new proceedings may be conducted before a differently constituted panel (integración diferente).

IV. In view of the ruling, there is no need to resolve the remaining objections and challenges filed

THEREFORE:

The appeals filed by attorney José Alejandro Alpízar Arrones on behalf of the Ministerio Público; by attorney Andrés Alfaro Ramírez on behalf of the Procuraduría General de la República; and by attorney Álvaro Enrique Moreno Gómez on behalf of the defendants Nombre02 and Nombre01 are granted. Consequently, the challenged judgment is declared entirely without effect, and the case file is remanded to the court of origin for new proceedings before a differently constituted panel. Given the manner in which this matter is resolved, there is no need to address the remaining grounds raised in the various challenges. Resolución: 2022-0277 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, al ser las once horas veinticinco minutos, del veintitrés de febrero de dos mil veintidós.- RECURSOS DE APELACIÓN interpuestos en la presente causa seguida contra Nombre01, mayor, costarricense, cédula de identidad número CED01, nacido en Limón el 08 de abril de 1940, de oficio pescador, vecino de Portete; contra Nombre02, mayor, costarricense, cédula de identidad número CED02, nacido en Limón, el 29 de agosto de 1956, casado, de oficio comerciante; por el delito de USURPACIÓN DE BIENES DE DOMINIO PÚBLICO, en perjuicio de EL ESTADO. Intervienen en la decisión del recurso, la jueza Francini Quesada Salas y los co-jueces Gustavo Gillen Bermúdez y Alberto García Chaves. Se apersonaron en esta sede el Msc. Álvaro Enrique Moreno Gómez apoderado especial judicial del imputado Nombre02, el licenciado Juan José Picado Herrera defensor particular del imputado Nombre01, el licenciado José Alejandro Alpizar Arrones en representación de la Fiscalía Adjunta Agrario Ambiental y el licenciado Andrés Alfaro Ramírez en representación de la Procuraduría General de la República.

RESULTANDO:

I.Que mediante sentencia número 386-2021, de las dieciséis horas del dieciséis de junio de dos mil veintiuno, el Tribunal Penal del Primer Circuito Judicial de la Zona Atlántica, Limón, resolvió: "POR TANTO: De conformidad con lo expuesto, reglas de la sana crítica y artículos 39 y 41 de la Constitución Política, artículo 8 de la Convención Americana de los Derechos Humanos, artículos 14 y 15 del Pacto Internacional de Derechos Civiles y Políticos, artículos 1, 30, 31, 45, 103, 227 inciso 1) del Código Penal; artículos 2, 4 a 8 de la Ley de Zona Marítimo Terrestre, artículos 122 al 138 del Código Penal de 1941 sobre las Reglas Vigentes Sobre Responsabilidad Civil, artículos 1 a 6, 11 a 13, 16, 37 al 41, 70, 71, 75 a 83, 91, 92, 94, 95, 97, 111 al 124, 142, 143, 180 al 184, 265 a 270, 308, 360 a 365 y 367 del Código Procesal Penal, artículos 632, 704 y 1045 del Código Civil, este Tribunal resuelve A.- se declara sin lugar la Actividad Procesal Defectuosa incoada por el Lic. Álvaro Moreno, B.- se absuelve de toda pena y responsabilidad a Nombre03 Y Nombre01, por los hechos acusados y querellados en su contra, y que fueron calificados como constitutivos de un delito de USURPACIÓN DE BIENES DE DOMINIO PÚBLICO, que se le venían atribuyendo en perjuicio del Estado.

C.- Se declara con lugar la acción civil resarcitoria, interpuesta por La Procuraduría General de la República, en contra de los demandados civiles Nombre03 y Nombre01, debiendo pagar de forma solidaria los demandados civiles el daño causado por la detentación que han hecho de bienes de dominio público, concretamente, de la Zona Pública de la Zona Marítimo Terrestre en la zona de Portete, dicho extremo se hace en abstracto en razón de que no se cuenta con elementos de prueba que otorguen parámetros objetivos que permitan establecer el monto concreto de la indemnización, debiendo acudir la parte a la vía de ejecución de sentencia a cuantificar los mismos. Adicionalmente se condena a los demandados civiles al pago de ambas costas de esta acción, tanto las personales como las procesales, costas que también se condena en abstracto, en razón de que no existe una cuantía sobre la cual calcularlos.

Asimismo, se condena a la parte vencida al pago de los intereses de ley sobre dichas sumas a partir de la firmeza del fallo y hasta su efectivo pago, fijándose la tasa de interés en la establecida por el Banco Central de Costa Rica. D.- Se ordena la restitución del área que dentro de la zona pública se ha discutido en el presente proceso a favor del Estado, ordenándose el derribo de las estructuras descritas en las piezas acusatorias y la acción civil e identificadas en el considerando respectivo de esta sentencia, debido a que las mismas se encuentra dentro de la Zona Marítimo Terrestre, área inalienable, así como la limpieza del lugar. Dicho derribo deberá efectuarlo la Municipalidad de Limón, al ser la encargada de la administración de esa área, el derribo deberá efectuarse en un plazo improrrogable de tres meses a partir de la firmeza de esta sentencia, en caso de no procederse como se ha ordenado, podría incurrirse en el delito de Desobediencia a la Autoridad, los costos del derribo y limpieza de la zona, serán trasladados a los imputados e involucrados.

E.- Se mantiene la Medida Cautelar ordenada en autos, en tanto otorgó de manera provisional, la posesión por parte de la Policía de Guardacostas de Limón, para que continúe en su labor de custodia del lugar. Dicha medida fue ordenada por todo lo que dure el proceso, por lo que la misma se mantiene hasta la firmeza de la presente sentencia, acaecida la firmeza, deberán ser destruidas todas las estructuras, incluidas las ocupadas por la Policía de Guardacostas. Quedan los gastos del proceso penal a cargo del Estado. Firme este fallo, ejecútese lo ordenado y archívese el expediente. Sobre la prueba material, se resuelve que la misma sea destruida una vez que la presente sentencia adquiera firmeza. Por lectura notifíquese" (sic).

II.Que contra el anterior pronunciamiento, Msc. Álvaro Enrique Moreno Gómez, el licenciado Juan José Picado Herrera, el licenciado José Alejandro Alpizar Arrones y el licenciado Andrés Alfaro Ramírez interpusieron recurso de apelación.

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta la jueza de Apelación de Sentencia Penal Quesada Salas; y,

CONSIDERANDO:

I.Admisibilidad e Inadmisibilidad. Mediante escrito presentado en fecha 13 de julio de 2021, el defensor particular, el licenciado Álvaro Enrique Moreno Gómez, en representación de los imputados Nombre02 y Nombre01, así como en representación de Nombre04, Nombre05, Nombre06, Nombre07, Nombre08 y Nombre09, en su condición de terceros civilmente demandados por medio de escrito presentado en fecha 14 de julio de 2021; el defensor particular el licenciado Juan José Picado Herrera, en representación de Nombre01, además, por escrito presentado el 23 de julio de 2021, por el licenciado José Alejandro Alpízar Arrones, en representación del Ministerio Público, y mediante escrito presentado en fecha 28 de julio de 2021, el licenciado Andrés Alfaro Ramírez, en representación de la Procuraduría General de la República, interponen recursos de apelación los dos primeros, y de apelación por adhesión los dos segundos, en contra de la sentencia dictada por el Tribunal Penal del I Circuito Judicial de la Zona Atlántica, número 386-2021, de las 16:00 horas del día 16 de junio de 2021, en la que se absolvió de toda y pena y responsabilidad a Nombre03 y Nombre01, por el delito de usurpación de bienes de dominio público, en perjuicio del Estado.

Del estudio del sumario se colige que los recursos se presentaron en tiempo, conforme al plazo de ley, y de acuerdo a los presupuestos que se requieren para que las impugnaciones posibiliten el adecuado y correcto conocimiento de las inconformidades planteadas por los recurrentes, en orden al examen integral de la sentencia impugnada, tal y como lo establece el artículo 8.2h de la Convención Americana sobre Derechos Humanos, y lo regulan los artículos 458, 459, 460 y 462 del Código Procesal Penal.

II.Siendo que el Recurso de adhesión presentado por el licenciado Alejandro Alpízar Arrones, en representación del Ministerio Público; el primer motivo del recurso de apelación por adhesión presentado por el licenciado Andrés Alfaro Ramírez en representación de la Procuraduría General de la República; y el cuarto motivo del recurso de apelación presentado por el licenciado Álvaro Enrique Moreno Gómez, plantean disconformidad con la fundamentación de la sentencia, se procederá a resolver todos en forma conjunta. Se afirma que se está de acuerdo en la absolutoria dictada, aunque lo fue por las razones incorrectas, motivo por el cual se estableció una reparación pecuniaria a favor de la Procuraduría General de la República y en contra de los imputados. Se reclama que en el fallo se transcriben las manifestaciones realizadas por los testigos, pero no se realizó valoración alguna de ellas. Se aduce que a los imputados no se les debió de absolver por la aplicación de un error de prohibición, sino por atípicidad de la conducta, de allí que no se configuraba el injusto penal.

Se insiste nuevamente en que la playa de Nombre10 se encuentra incluida dentro de las disposiciones de la ley 6043. Se rechaza el criterio del órgano juzgador que validó un oficio del director del Instituto Nacional Geográfico de 1980, para ubicar las coordenadas de Nombre10 en otro lugar que recibe el nombre de Playa Bonita, y a partir de allí, considerar que Playa Nombre10 no se encuentra dentro de la zona urbana de la ciudad de Limón. Se fustiga que para el tribunal de mérito había que respetar las coordenadas emitidas por dicho oficio como el límite de la ciudad, aunque tal argumento fuera contrario a derecho. Se insiste que el núcleo de discusión no es si Nombre10 es zona marítimo terrestre o no, sino que los alegatos de la defensa eran que la zona litoral de Portete, es un barrio de la ciudad litoral de Limón, por lo que es una zona excluida de la aplicación de las disposiciones de la ley 6043 sobre zona marítimo terrestre, rechazando la utilización de un oficio del Director del Instituto Nacional Geográfico, de 1980 en la que se habían ubicado las coordenadas de Nombre10 en otro lugar que recibe el nombre de Playa Bonita, para justificar que la zona de Nombre10 está fuera de los límites de la ciudad.

Para la defensa, la zona litoral de Nombre10 y su bahía, no están ubicadas en la zona pública de 50 metros desde pleamar, y las disposiciones de la Ley 6043, sobre las restricciones de la zona marítimo terrestre, se insiste no le son aplicables a Playa Portete, por ser parte de la zona urbana de la ciudad litoral de Limón. Se objeta que, con base en ello, se pueden inscribir registralmente fincas particulares con linderos al mar caribe, se puede construir estructuras a la vera del espejo de agua o donde llega la pleamar ordinaria, siendo la Municipalidad de Limón, el ente que puede realizar actos administrativos en dicho lugar. También se alega que ante tal situación es que en la “zona pública” de la ciudad de Limón, dentro de la que se encuentra “Playa Portete”, se permiten realizar actividades comerciales lícitas de turismo y pesca contiguo al mar en Playa Bonita, Pitua y centro de la ciudad, en la que se realizan actividades y en las mismas condiciones que los ocupantes de Portete.

También se explica que dentro de la ciudad costera de Limón no se aplican las restricciones de la zona marítimo terrestre, siendo ese el motivo por el cual el edificio del Poder Judicial de Limón, se encuentra cerca del mar en la ciudad de Limón. Se afirma que las actividades pesqueras son fomentadas como de interés nacional, de allí que en el artículo 5 de la Ley de Pesca y Acuicultura, se protege dicha actividad, lo que generó la creación de las leyes 9073 a la 9577, las cuales protegieron a los pescadores contra la ejecución de desalojos y demoliciones. Se explica que la ley mas reciente en ese sentido fue la ley aprobada el 1 de julio del 2021, ley número 10000 que ordena suspender los desalojos en la zona marítima terrestre y obstaculizar las actividades comerciales lícitas hasta el 1 de julio del año 2024. También se alega que incluso el Concejo Municipal aceptó construir una terminal pesquera junto con Japdeva e Incopesca en la Bahía de Portete, según plan regulador conforme a las necesidades del cantón.

Como segunda disconformidad se reitera que la conducta de los acusados era atípica, y por ende el criterio del tribunal de mérito de que la conducta desplegada era típica, antijurídica mas no culpable, era inaceptable jurídicamente. Se enfatizó que la actuación de los sindicados no fue dolosa, ya que ellos no tenían conocimiento ni la voluntad de detentar terrenos del Estado. Se afirma que la finca en la que los pescadores vivían, pertenecía a Nombre11, propiedad que tiene escritura, plano inscrito y linderos hasta la pleamar, por lo que se insiste en que los pescadores no tenían el conocimiento de cometer el ilícito acusado o al menos no imaginaron que esto fuera posible. Se añade que los sindicados fueron acusados y querellados por detentar un bien demanial o de dominio público al que se llama “zona pública” pero que todavía no tiene el rango de dominio público, por lo que se insiste que de mala fe, en sentencia se obvió los linderos norte de los estudios registrales actualizados al día de hoy de la finca donde vivían los sindicados.

También se alega que en ningún momento se acreditó que cuando a los imputados se les permitió el uso y habitación de las dos estructuras que usaban como casa de habitación desde antes del año 1991, y que estaban dentro de una parte de la finca privada de Nombre11, inscrita con sujeción a la ley desde antes de 1977, esos terrenos estuvieran declarados como bienes de dominio público, mucho menos que se hubiese ordenado la expropiación del Estado. Aunado a ello, se afirmó que nunca se les previno de que desalojaran el lugar. Se reclama que para acusarlos de la acción de “detentar” debieron realizar la advertencia de devolver el bien a quien pertenecía. Se insiste que ambos encartados tenían derecho a poseer, porque el propietario de la finca, se los había dado, por lo que no habían sido perturbados en su posesión legítima, de forma que tampoco se podía sostener que ellos detentaron dicha propiedad.

El recurrente cuestionó la veracidad de los conocimientos del oficial judicial Nombre12 sobre la aplicación e interpretación de las leyes vigentes con relación a la playa de Portete, como para que el tribunal basara la resolución en ellos. Se cuestionó que no se analizó la declaración de Nombre13, con relación a la Ley de Zona Marítima Terrestre y la no aplicación de sus regulaciones a Playa Portete. Como tercera disconformidad, se planteó que el Instituto Nacional Geográfico, llamado en adelante “ING”, respondió que no existía amojonamiento en la zona de Portete, por lo que no se podía brindar respuesta si las construcciones se encontraban dentro de la zona pública protegida por la Ley de Zona Marítimo Terrestre, lo que en su criterio, desmintió las afirmaciones del oficial Nombre12 en ese sentido. Como cuarta disconformidad con la sentencia, se aduce una errónea interpretación de los dictámenes criminalísticos periciales realizados por el ingeniero forense Nombre14 del Organismo de Investigación Judicial y 2 ampliaciones de este, realizadas en el año 2015.

Se objeta que el dictamen número DCF-2015-00746-IG, el DCF-2015-1247-ING y el DCF-2017-682-ING, no permitieron fijar con certeza la ubicación de la zona marítimo terrestre, debido a una ausencia de amojonamientos en la zona. Además, que en dichos dictámenes se utilizó como parámetro para definir el litoral de la ciudad de Limón, no las coordenadas establecidas por ley, sino el “Proyecto de Limón-Ciudad Puerto”, el cual no está basado en los límites urbanos de la ciudad litoral de Limón. Además, de que en el mismo se objetó que no existía amojonamiento oficial de la zona marítimo terrestre en Playa Portete, por lo que tampoco se podía definir que el área de estudio se localizaba junto el área recreativa nacional Cariari, pero no se logró obtener información gráfica que permitiera conocer los linderos del parque. Se fustiga que en la ampliación del peritaje 2015-1247-ING, se marcó una zona pública sin tener amojonamiento, en la que además el recurrente alegó que la pleamar no coincide con la faja de 50 metros.

En el informe 746-ING-2015 se indicó que sobre la delimitación de la zona pública, lo que existe es una delimitación digital y que no existía mojones físicos. Luego se refuta, que se incluyó un croquis en la que las construcciones en estudio se encontraban localizadas en parte dentro de la zona pública y de la pleamar, sin definir si las casas de los sindicados se encontraban dentro o fuera de esta área. Además, se acota que existió un error en la forma en que se fijó en el croquis la zona marítimo terrestre en la Playa de Portete, la que se alega fue establecida, no iniciando en la pleamar como estipulan los artículos 9 y 10 de la Ley 6043, sea la orilla de la Bahía de Nombre10 o de las estructuras, sino que el perito la ubicó mucho mas adentro, alterando la medida de la faja de zona pública, la que fijó, más allá de los 50 metros desde la pleamar que ordena la ley, generando una confusión insalvable sobre la ubicación de la zona pública.

Pese a lo dispuesto por dichos dictámenes, se insiste, se ordenó desalojar mediante la aprobación de una medida cautelar. Se reiteró que inicialmente, en el dictamen 2017-683-ING, se marcó digitalmente en un croquis y sin mojones físicos una zona pública dentro de la zona marítimo terrestre de Portete, luego, por segunda vez, se fija en la ampliación del dictamen, otra zona marítimo terrestre en la que la pleamar tampoco coincidía con la faja de 50 metros marcados, ni con lo indicado a folio 538 del peritaje anterior. Se explicó que en la ampliación del dictamen DCF-2015-1247-ING, en la que se solicitó medir la cantidad de metros cuadrados que estaban ocupando cada una de las estructuras, se adjuntó ampliado nuevamente la zona o faja de 50 metros ubicada mucho más distante aún de la pleamar y totalmente diferente a la que marcó en el croquis anterior a folio 538. Se refuta que el croquis a folio 538, ubicó las estructuras dentro de la zona pública y el croquis a folio 1061 fijó las estructuras fuera de la zona pública, de allí lo confuso de la prueba pericial.

Se alega que con base en la prueba pericial, no existió certeza sobre la fijación de la zona pública. Con relación al peritaje DCF-2016-2230-BIO, de folio 992 a 999, indicó que que para el 14 de noviembre del 2016, no existía una delimitación geográfica para definir si el muelle de Nombre10 de Limón se ubicaba en zona rural o urbana por lo que no fue posible evacuar la consulta en cuanto a si el muelle se encontraba en la zona declarada ciudad Limón. Con relación a la ubicación geográfica de las casas de Nombre02 y Nombre01, se indicó que en cuanto a la casa de Nombre15 no se determinó si ésta se encuentra dentro de los 50 metros desde la pleamar ni la marca dentro de ninguna zona pública, y en el caso de la casa de Nombre01 tampoco se determinó si se encuentra dentro de los 50 metros desde la pleamar ni la marca dentro de ninguna zona pública. También se objeta el dictamen DCF-20017-583-BIO a folio 1052-157 que tampoco definió el área de zona pública.

También se refuta que el tribunal haya cuestionado la legitimidad de la finca inscrita a nombre de Nombre11 simplemente con lo dicho por el perito Nombre16, en el sentido de que habían planos con relación a la tramitación de la información posesoria pero ninguno inscritos, cuando reclamó la defensa que se ofreció a folios 2441 a 2450, el plano L—0057463 que generó la inscripción de la finca matrícula real número a nombre de Nombre11. Además como el perito ombre17 dijo que no podía afirmar que la casa de los imputados estuviera dentro de la cabida de la Dirección01 de la finca de Astorga, cuyos linderos norte llegan hasta la pleamar o bien dentro de lo expropiado por ICODER, lo que era deber del Ministerio Público acreditar o descartar. El tribunal simplemente descartó tal posibilidad, en contra de los intereses de la defensa. También se objeta que el artículo 5 de la Ley de la Zona Marítima Terrestre, indica que la municipalidad puede conceder permisos para resguardo de las personas y seguridad en la navegación.

Se reclama que el tribunal juzgador no contempló en sentencia el reglamento N-7841-P de la ley 6043, artículo 22, sobre las potestades de las autoridades administrativas. También criticó que el tribunal de mérito confundió el cero daño ambiental determinado por el SINAC en Portete, con el impacto ambiental, ya que impacto ambiental es la modificación del ambiente ocasionada por la acción del hombre o de la naturaleza y daño ambiental es toda acción, omisión, comportamiento u acto ejercido por un sujeto físico o jurídico, público o privado, que altere, menoscabe, transtorne, disminuya o ponga en peligro inminente y significativo, algún elemento constitutivo del concepto de ambiente. Se objeta que en dicho informe se indicó que no hubo daño ambiental en términos de afectación derivados por cambios en los servicios ambientales y/o ecosistemáticos producidos por la construcción del muelle ombre10,, por lo tanto, en su criterio, no procedía realizar una valoración económica del daño ambiental, información que también se reclama no fue valorada en sentencia, por lo que se alega no era procedente ordenar la demolición de las estructuras.

Se fustiga la falta de valoración de los documentos aportados por la defensa, los que se critica, fueron someramente mencionados en el fallo, sin valorar con detalle los mismos, dentro de los que estaba la resolución 624-F2017 del Tribunal Colegiado Agrario del II Circuito Judiciak de San José, donde se concluyó que a ombre10 no se le aplicaban las disposiciones de la ley 6043, con relación a la disputa de terreno donde la casa de ombre03 y el Icoder estaba dentro del terreno expropiado a Astorga, y este afirmaba lo contrario, así como se opuso a la incorporación como prueba para mejor resolver el peritaje de Nombre18 IT 16025, en el que se le dio la razón a Nombre19, que no era zona marítimo terrestre, ni en la franja de 50 metros de la pleamar. Se reitera que la conducta es atípica, por lo que se solicita la absolutoria de los imputados por dicho extremo y no por aplicación de un error de prohibición invencible.

Contestación de las partes. Se hace constar que a folio 153 vuelto, se emplazó a las partes con relación a los recursos presentados por los licenciados Álvaro Enrique Moreno Gómez y el licenciado Juan José Picado Herrera, defensores particulares de los sindicados Nombre01 y Nombre15, sin que se haya presentado pronunciamiento alguno. Recurso de apelación por adhesión presentado por el licenciado José Alejandro Alpízar Arrones, en representación del Ministerio Público. Inconformidad con la fundamentación jurídica. Se reclamó que el tribunal de juicio aplicó en forma errónea la existencia de un error de prohibición directo invencible a favor de los encartados Nombre01 y Nombre02 quienes alegaron que creían tener derecho de permanecer viviendo en el lugar, cuando en criterio del recurrente tenían clara comprensión de la prohibición de la conducta acreditada. Se alega que no se analizó que los sindicados sabían que todas las playas de Costa Rica son públicas, circunstancia que elimina toda posibilidad de alegar un error de prohibición.

Se indica que dentro de los elementos de prueba, se contó con el testimonio del oficial del Organismo de Investigación Judicial, Nombre12, quien manifestó que desde la vivienda de los dos encartados se podía ver claramente el mar y apuntó que podía calcular que el espejo del agua estaba a no mas de 50 metros de distancia de las viviendas. Además de que los peritajes emitidos por el Laboratorio de Ciencias Forenses, acreditaron que todas las obras estaban dentro de los 50 metros de la zona pública. Considera el recurrente que era evidente para ambos encartados que estaban viviendo en una playa, lo que está prohibido en todo el territorio nacional, sin excepción, ya que se afirma, los litorales costarricenses poseen una zona pública inalienable de 50 metros. Se alega que no importa si la vivienda se ubica dentro de alguna ciudad portuaria o no, pues la excepción a la que alude la Ley sobre la Zona Marítimo Terrestre se refiere únicamente a la inexistencia de zona restringida dentro de las ciudades enlistadas en la propia ley, siendo que dicha excepción no abarca la zona pública, misma que siempre será un bien de dominio público cuyo vocación es el uso y disfrute de las personas, así como la conservación del ambiente.

También se añade que el testigo Nombre13, funcionario municipalde la localidad de Limón, quien aseguró tener amplio conocimiento en el tema de la zona marítimo terrestre y afirmó que siempre hay zona pública, aún en zonas urbanas, sin importar la excepción de la ley. Por ende, se alega que si la zona pública mantiene su régimen jurídico como dominio público, sin importar donde se encuentre, los encartados no podrían alegar un error de prohibición. También se indica que el numeral 70 de la Ley de Zona Marítima Terrestre, establece que aquellos pobladores que ocupan la zona marítima terrestre desde la fecha anterior a la emisión de la ley podrán seguir ocupando el área, pero, deberán de respetar la zona pública. Es decir, que los particulares deben de dejar libre el espacio de la zona pública, lo que se afirma, coincide con lo juzgado en el presente caso, pero que en criterio del impugnante, se consideró que los sindicados actuaron creyendo que su conducta no estaba prohibida.

Se cuestiona que desde el momento histórico en que se percataron que el sitio es una playa, desde ese mismo instante era evidente para los dos, que estaban ocupando espacio que es público y destinado al uso común, por lo que, no podían ocuparlo a título privado para sus fines particulares. Adicionalmente, se citan los dictámenes C-330-2020, y C-004-1980, de la Procuraduría General de la República, los cuales aunque no son jurisprudencia que vincule a los tribunales de justicia, sí pueden ser tomados en consideración para determinar cómo se ha regulado administrativamente el régimen jurídico de la zona pública, pues se afirmó que en última instancia la ley 6043 le confirió a las municipalidades el deber de administrar dicho espacio físico y la jurisprudencia administrativa de la Procuraduría General de la República ha delimitado cómo se administrará esa franja de terreno. Se solicita se anule la sentencia y se ordene realizar un juicio de reenvío para el extremo de la responsabilidad penal.

Sobre los demás aspectos resueltos en la sentencia solicita se mantengan incólumes por estar ajustados a derecho. Primer motivo presentado por el licenciado Andrés Alfaro Ramírez en representación de la Procuraduría General de la República. Inconformidad con la fundamentación jurídica. Se reclama que el tribunal aplicó en forma inadecuada el error de prohibición, al considerar que los imputados no tenían una clara comprensión sobre la prohibición de las conductas acreditadas y que les atribuyeron a lo largo del presente proceso. Se reclama que no se consideró que un habitante del cantón de Limón, no puede alegar desconocimiento sobre la legislación de la playa ubicada en la zona, siendo que las viviendas que habían habitado los justiciables, se encuentran situadas dentro de los 50 metros de la zona pública de la zona marítimo terrestre, ya que se reclama que todas las playas de Costa Rica son públicas y que nadie puede habitar en esos sectores por ser zonas de dominio público inalienable, lo que elimina en su criterio, la posibilidad de cualquier error.

Se cita la declaración del testigo Nombre12 investigador del Organismo de Investigación Judicial, quien manifestó que desde la vivienda de los señores Nombre02 y Nombre01, resultaba observar el mar y que el espejo del agua del océano se visualizaba a menos de 50 metros de distancia de las viviendas, lo que fue reforzado con los peritajes emitidos por el Laboratorio de Ciencias Forenses, los que confirmaron que todas las estructuras, incluidas las de los encartados, se encontraban dentro de los 50 metros de la zona pública de la zona marítimo terrestre, por lo que se cuestiona que los justiciables no podrían alegar que ignoraban que estaban viviendo en la playa. También se añade que los litorales costarricenses poseen una zona pública inalienable de 50 metros, sin que exista ningún tipo de excepción al respecto, sin importar si se ubica dentro de alguna ciudad litoral o no, pues la excepción a la que alude la Ley sobre la Zona Marítimo Terrestre se refiere únicamente a la inexistencia de zona restringida dentro de las ciudades enlistadas en la propia ley.

Se añade que la excepción de la existencia de la zona restringida en las ciudades litorales, no abarca la zona pública, la que siempre será un bien de dominio público, cuya vocación es de uso y disfrute de cualquier persona, así como la conservación del ambiente, pues de lo contrario, en toda ciudad litoral del país existirían construcciones dentro de la zona pública, lo que es imposible. Por ende, si la zona marítimo terrestre, mantiene su régimen jurídico como bien de dominio público, sin importar donde se encuentre, se afirma que los endilgados sí conocían la ilicitud de su conducta. Se indica que en el numeral 70 de la Ley de la Zona Marítimo Terrestre, se establece que quien ostente la calidad de poblador en terrenos o inmuebles que ocupan la zona marítimo terrestre desde la fecha anterior a la emisión de la ley, tienen la posibilidad de seguir ocupando el área, respetando la zona pública de 50 metros.

Es decir, que pueden ocupar el área restringida de 150 metros, mas no la zona pública. Se solicita se anule la sentencia únicamente en cuanto al extremo de la aplicación de un error de prohibición. Contestación de la defensa. Con relación al único motivo del recurso presentado por el licenciado José Alejandro Alpízar Arrones. El máster Álvaro Enrique Moreno Gómez, defensor particular del imputado Nombre15, a folio 170 vuelto, solicita sean declarados sin lugar los dos recursos de apelación por adhesión interpuestos. Se afirmó que en primer lugar, en sentencia no se acreditó que el endilgado estuviera viviendo en una playa, se afirma que el que viva cerca del mar no necesariamente implica vivir en una playa. Además de que el investigador Nombre12 haya manifestado que desde la vivienda de los dos encartados se pudiera ver el mar, no es sinónimo de que estén viviendo en la playa. Se añade que el testigo, sin ser perito, apuntó que el espejo del agua se podía calcular a menos de 50 metros, sin embargo el sindicado ombre03 declaró en juicio que eran mas de 50 metros.

También indicó que en cuanto a la zona pública de 50 metros determinada por los 2 peritajes cuestionados, ambas demarcaciones no iniciaron desde la pleamar sino mas adentro de tierra, por lo que ninguna de las dos zonas marcadas por los peritajes es real, tal y como se reprocha y se demostró en la apelación de la sentencia. También se refiere que el concepto jurídico de playa y zona pública es muy distinto, siendo que se fustiga que para el Ministerio Público es lo mismo, confundiendo su utilización, tal y como lo intentó al excluir el expediente sobre la prueba técnica del SINAC-ACLAC-DR-0446-15, del 23 de noviembre del 2015, que establecía la inexistencia de un daño ambiental en ombre10 o asegurar falsamente durante el debate que la ley 9577 había sido declarada inconstitucional. También se refuta que no es cierto que no hay excepciones para la zona pública, puesto que en la ley 6043 así se establece, de lo contrario se tendrán que derribar los Tribunales de Justicia de Limón y el Hospital Tony Facio, construidos a menos de 50 metros del espejo de agua.

Se alega que hay espacios o fincas que tienen zona pública dentro de la zona marítima terrestre que todavía están inscritas legalmente como fincas privadas y que para pasar al dominio público deben ser expropiadas. Se alega que no es cierto lo que afirmó el fiscal, ya que desconoció los alcances de la ley 6043 sobre la zona marítima terrestre y su reglamento. Se fustiga que del centro de la ciudad de Limón hasta Moín hay cientos de casa o estructuras construidas dentro de los 50 metros de zona pública sin que sean ilegales por ser zona urbana de una ciudad litoral. Se añade que el afirmar que el endilgado tenía conocimiento de lo ilegal de su actuación, es una apreciación subjetiva, no solo porque no fue probada en juicio, sino también porque se acreditó que los justiciables habitaban en una porción de tierra inscrita por un particular desde antes del año 1977 y que aún no había sido expropiada.

Con relación al primer motivo del recurso presentado por el licenciado Andrés Alfaro Ramírez en representación de la Procuraduría General de la República, indicó la defensa que no hubo una sola prueba que asegurara con precisión que la vivienda de su representado se encontrara ubicada dentro de la playa o dentro de los 50 metros de la zona pública. Nuevamente, se afirmó que no se pudo demostrar en juicio que el encartado estuviera viviendo o que estuvo viviendo en una playa, ya que el concepto jurídico de playa y zona pública es muy distinto. También se afirmó que no es cierto que no existiesen excepciones para la zona pública en la ley 6043. Se reiteran argumentos esbozados en el motivo anterior, para culminar afirmando que el considerar que el imputado debía conocer que actuaba ilegalmente, es una apreciación subjetiva del recurrente, siendo que se probó en juicio que el endilgado habitaba en una porción de tierra inscrita por un particular desde antes del año 1977, y que aún no había sido expropiado. Se solicita se declaren sin lugar ambos recursos.

III.Los anteriores recursos deben ser declarados con lugar, pero por motivos parcialmente diferentes a los alegados. Habiéndose impuesto esta cámara de los alegatos incluidos en sentencia, se detectan una serie de errores en la fundamentación, que invalidan los argumentos desarrollados y que no permiten que la resolución venida en alzada pueda ser confirmada. El tribunal, conforme se aprecia a folio 35 y 36 de la sentencia, del legajo de apelaciones, explicó que los temas de discusión estuvieron basados en dos grandes vértices; el primero relativo a si Nombre10 era parte o no de la ciudad costera de Limón, y el segundo, si las casas de habitación de los imputados se encuentran dentro de la zona pública de Portete; siendo justamente sobre la precisión de estos dos ejes que se detectaron los vicios en la fundamentación, los cuales se explican a continuación. El primer yerro está referido en los argumentos en que se basó el rechazo de la actividad procesal defectuosa, por falta de legitimación activa del Ministerio Público y la Procuraduría General de la República.

Con relación al descarte de la misma, si bien este fue realizado conforme a derecho, lo que no resulta procedente son los argumentos con los cuáles se excluyó la teoría de la defensa de que Playa Nombre10 era parte de la ciudad costera de Limón, la cual reiteró en el análisis de fondo, y que socavaron la legalidad de la decisión jurisdiccional apelada en su totalidad, por la esencialidad del tema discutido. Se afirmó que Playa Nombre10 no se encuentra dentro de los límites de la ciudad urbana de Limón y, el tribunal de juicio en apoyo a tal decisión, indicó lo siguiente: 1-Que con base en la Ley de Creación y Organización del Instituto Geográfico Nacional (ING), en su artículo 1, el ING es el ente rector de la cartografía nacional, destinada a la ejecución del mapa oficial y la descripción geográfica de la República de Costa Rica; lo cual es correcto. 2- Se explicó que el ING, mediante pronunciamiento número 222 del 2 de setiembre de 1980, emitido por Nombre20, detalló los límites de las ciudades contempladas como excepción a la aplicación de la Ley sobre Zona Marítimo Terrestre, oficio que considera el órgano decisor surgió con el fin de complementar la excepción del artículo 6 de la ley número 6043 sobre la protección de la zona marítimo terrestre, referida a que las ciudades costeras quedan excluidas de las disposiciones de dicha ley;argumento que esta instancia no comparte.

La relevancia sobre el tema yace en que, si Nombre10 es parte de la ciudad de Limón, se le aplicaría la excepción estipulada en el artículo 6 de la ley 4063 Ley sobre la Zona Marítimo Terrestre, que exceptúa de las disposiciones de dicha ley a las ciudades costeras. Para resolver dicho extremo, ha de estudiarse la ley número 2906 del 24 de noviembre de 1961, titulada “Declaración Zona Recreo y Turismo Franja entre Nombre10 y 12 Millas de Limón”, la cual establece en su artículo 1, lo siguiente: “Se declara zona de recreo y turismo la faja de 200 metros de ancho, desde la pleamar ordinaria, comprendida dentro de la milla marítima entre el límite norte de la zona urbana de la ciudad de Limón, o sea Portete, y el sitio conocido con el nombre de “12 Millas” o “Swamp Moth”, al norte de la ciudad de Limón, así como la zona comprendida dentro de los 100 metros de ambos lados del Río Moín en la sección paralela a la playa.

De la referida zona se reservan veinte metros para una carretera panorámica en los sitios en donde en la actualidad no existe. El resto se traspasará al Instituto Costarricense de Turismo, como parte de su capital, que dispondrá de acuerdo con las normas que la presente ley establece.” De su redacción se logra concluir que, al citar como límite norte de la zona urbana de la ciudad de Limón a Portete, no se especificó si los límites llegaban hasta Playa Portete, incluyéndola o excluyéndola. Posteriormente, se tiene la ley número 4366 de 1969, sobre la División Territorial Administrativa de la ciudad de Limón, que en el artículo 8 establece que las provincias de Costa Rica se dividen en cantones, indicando expresamente en dicho numeral que la provincia de Limón se divide en los cantones: Limón, Pococí, Siquirres, Talamanca ( Ley 4339 de febrero de 1970), Matina ( Ley 4344 del 24 de junio de 1969) y Guácimo, este último creado mediante la ley 4753 del 3 de mayo de 1971.

Posteriormente, mediante el Decreto Ejecutivo número 21515-6 del 10 de agosto a 1992, se indicó la legitimidad del Instituto Geográfico Nacional para pronunciarse sobre los límites y numeración de los distritos, determinando mediante el Decreto Ejecutivo número 21720-6 publicado en la Gaceta número 239 del 14 de febrero de 1992, como cantones de la provincia de Limón: Limón, Valle de Estrella, Río Blanco y Matina. En la ley número 4366 de 1969, en su artículo 10, se indicó en el párrafo segundo que la división entre cantones deberá seguir límites naturales; y sólo cuando esto no fuere posible, se señalarán líneas rectas geodésicas. En el párrafo tercero se indica que cuando en la separación de cantones, hubiere líneas rectas geodésicas no naturales, los cantones colindantes financiarán el amojonamiento, que será ejecutado por el Instituto Geográfico Nacional. Todo lo que permite entender que la variación de los límites de las provincias y cantones deberá realizarse por ley, no así la de los distritos, ley que además legitima al ING en dicha función, así como lo hace la Ley de Creación y Organización del Instituto Geográfico Nacional, ley número 59 del 4 de julio de 1944, que la constituye como la entidad oficial en el área cartográfica, geográfica y geodésica.

De forma que, el Instituto Geográfico Nacional es el ente encargado de realizar los amojonamientos dentro del territorio nacional, ya que éste también será el encargado de preparar mapas provinciales y cantonales, los que deberán ser revisados cuando sea el caso. De forma que, los razonamientos del tribunal en ese sentido fueron correctos. El problema está en que, aunque el Instituto Geográfico Nacional es el ente competente para crear el acto administrativo, dicho oficio, o pronunciamiento número 222 emitido el 2 de setiembre de 1980, el tribunal omitió indicar en su sentencia a que folio consta el mismo, el cual como documento tampoco fue incorporado como prueba documental, y por sí solo no es oponible a terceros. Aún y cuando el a quo no lo especificó, podríamos inferir que la información sobre la existencia de dicho oficio, fue extraída de la copia del Informe Técnico del Director del IGN, Max Lobo Hernández, que es parte de las copias de los documentos admitidos e incorporados, pertenecientes al expediente 19.783 de la Asamblea Legislativa, titulado: “Investigación sobre las circunstancias en torno a la construcción de un muelle privado en Bahía Portete, en el cantón central de Limón”, el que el tribunal indicó que se encontraba a partir del folio 935, y que fue analizado en sentencia a folio 43, en el que citó nuevamente la existencia del oficio ya mencionado, pero añadió que dicho pronunciamiento fue comunicado al Director de Catastro Nacional, fijando así los límites de la ciudad de Limón, especificando que la delimitación en el sector era digital georeferenciada.

Este acto administrativo interno, lo que permitió es que el Catastro Nacional tuviera información sobre los límites litorales de la ciudad de Limón, pero no así el resto de la población costarricense, ya que según los artículos números 120, 121, 122, y 123 de la Ley General de la Administración Pública, dicho acto administrativo debió ser publicado en el boletín oficial para que pudiera tener alcance a terceros. El numeral 120 indica que: “Para los efectos de clasificación y valor, los actos de la Administración se clasifican en externos e internos, según que vayan destinados o no al administrado; y en concretos y generales, según que vayan destinados o no a un sujeto identificado...” El artículo 121 de dicha ley establece literalmente: “1. Los actos se llamarán decretos cuando sean de alcance general y acuerdos cuando sean concretos. 2. Los decretos de alcance normativo se llamarán también reglamentos o decretos reglamentarios. 3.Los acuerdos que decidan un recurso o reclamo administrativos se llamarán resoluciones.

El artículo 122 establece que los actos internos carecerán de valor ante el ordenamiento general del Estado en perjuicio del particular, pero no en su beneficio. Es decir, que para que un acto administrativo sea oponible a terceros debe haber sido publicado mediante decreto ejecutivo, publicado en La Gaceta como Boletín Judicial, o bien, como acto oponible específicamente a los imputados, debe acreditarse que el mismo le fue debidamente notificado, lo que no se indicó en sentencia. De lo contrario, el acto administrativo, carecerá de valor ante el ordenamiento jurídico, lo que no permitiría que el tribunal se basara en dicho oficio número 222, para considerar que los imputados no se encontraban amparados por el artículo 6 de la ley número 6043 sobre la zona marítimo terrestre, porque dicho oficio así lo dispone. Ello no quiere decir que tal pronunciamiento no haya sido debidamente publicado, pero entonces es con base en dicho Decreto Ejecutivo, o aviso oficial, en que las autoridades judiciales deben basar sus resoluciones y aplicar lo que corresponda.

Curiosamente el único Decreto Ejecutivo número 36642-MP-MOPT-MINAE, al que se hizo referencia en sentencia, es el que establece en su artículo 20 que la delimitación digital georeferenciada es aplicable en aquellos sectores de la zona marítimo terrestre donde no existe delimitación con mojón físico. Sin embargo, nuevamente se expone, que lo que se cuestiona no es que el Instituto Geográfico Nacional no sea el ente facultado para fijar las coordenadas y realizar los amojonamientos, incluso virtualmente; lo que se refuta es que, para que el acto administrativo utilizado en la resolución impugnada, como base de su decisión, tenga alcance general, debe ser debidamente publicado en el diario oficial. Incluso así lo establece el artículo 63 del Reglamento número 7841-P de la Ley sobre Zona Marítimo Terrestre que textualmente indica: “El Instituto Geográfico Nacional deberá publicar los avisos en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública..” Dato al que no hizo referencia el tribunal juzgador, y que se extraña en la fundamentación de la sentencia.

Ahora bien, se tiene claro que una vez que se realizó el amojonamiento físico, ya no virtual, de Portete, se publicó en el boletín oficial la Gaceta, para el mes de noviembre del año 2015, el aviso u oficio en el que fijaron los límites de la ciudad de Limón, conforme al amojonamiento físico realizado hasta ese momento; sin embargo, ello no suple el vicio con respecto al oficio número 222, sobre amojonamiento virtual, del año 1980, que es el que el tribunal utilizó para indicar que desde el año 1980, legalmente se habían fijado los límites de la ciudad de Limón y la exclusión de Nombre10 de la zona urbana ya citada. Con relación al derecho de recurrir el acto administrativo, el jurista Manrique Lara ha indicado lo siguiente: “Los sujetos legitimados para interponer este recurso son lo titulares de intereses legítimos y derechos subjetivos. También como es lógico suponer, están legitimados los sujetos que mantienen un derecho que pueda resultar afectado por la resolución, lo que exige su apersonamiento en el procedimiento para ejecutar el derecho de recurrir ante el mismo órgano que dictó el acto objeto de impugnación.” (Nombre21.

“La Legitimación Administrativa”, 5ta edición, San José, página 72, 1991). Es decir, que la necesidad de que el acto administrativo sea publicado para que tenga alcance general, o el acuerdo sea debidamente notificado a los administrados, es para permitir primero que se cumpla con el derecho a ser informados y así poder ejercer el control sobre el mismo, mediante la impugnación, cuando éste se considere abusivo, o que afecta los intereses del administrado, y al ser enterado del mismo, pueda impugnar dicho acto mediante el procedimiento previamente establecido. Si el acto administrativo no es publicado, se impide que el administrado tenga conocimiento, por lo que el mismo no puede serle oponible ni exigible, y tampoco resulta válido. Con relación al alcance de un acto administrativo, jurisprudencialmente la Sala Constitucional ha mantenido el criterio que se ha venido sosteniendo, ello, por ejemplo, mediante resolución 11924-2008 del 30 de julio del 2008, en el que indicó que el decreto ejecutivo por principio es de alcance general, no necesita ser notificado en forma personal, pues sólo es necesario que sea publicado, siendo oponible a terceros a partir de ese momento.

La Sala Primera de la Corte Suprema de Justicia, sobre el tema explica que la sanción para un acto administrativo que no cumple el procedimiento legalmente establecido, es la invalidez del mismo, lo que se extrae del siguiente extracto de las resoluciones números 1242-2020 del 31 de marzo del año 2020 y la 254-F-S1-2011 de las 9 horas 25 minutos del 10 de marzo de 2011, en el que indica lo siguiente: “(…) se concibe el acto como una declaración unilateral de voluntad, conocimiento o juicio efectuado por las Administraciones Públicas en el ejercicio de la función administrativa, el cual produce efectos jurídicos concretos o generales, de naturaleza normativa o no, de modo directo o indirecto, en uso de sus potestades. Se estima válido en el tanto sea acorde al ordenamiento jurídico (artículo 128 LGAP). Además se exige, sea dictado por el órgano o ente competente y se cumplan todos los requisitos y trámites legales exigidos (numeral 129 ibídem).

Se clasifican estos últimos en dos grupos, formales y materiales. Los primeros están dirigidos al ejercicio de la potestad que autoriza la conducta pública, consistentes en el procedimiento, la forma (manera cómo se exterioriza) y el sujeto (competencia). Por otra parte los materiales están vinculados con el fin del acto y enmarcan la actividad que pretende realizar la Administración; los constituyen el motivo, el contenido y el fin (…)”. Por lo que resulta de vital relevancia la corroboración de que el oficio citado en sentencia haya sido debidamente publicado, conforme lo exige la legislación ya citada. Con relación al pronunciamiento 222 del IGN, como acto administrativo, la sentencia venida en alzada, incluyó como argumentos para validar dicho acto administrativo y oponerlo a los imputados los siguientes razonamientos. A folio 9 del legajo de apelación, en el fallo, se indicó como primer argumento, que el IGN era el ente autorizado para fijar las coordenadas de las ciudades costeras, ya sea virtual o físicamente, mediante un pronunciamiento o aviso, lo que es cierto, sin embargo, como segundo argumento textualmente manifestó lo siguiente: “Segundo, no hay forma de acreditar lo que afirma el Lic. Nombre14, en el sentido de que ese acto administrativo por medio del cual el IGN comunicó las coordenadas del límite de la ciudad de Limón, obedezca solamente a la voluntad subjetiva del director del IGN.

Esa afirmación de la defensa es la que por completo es una apreciación subjetiva. Es claro que los actos administrativos constan de actos preparatorios e insumos que llevan a su concreción, el hecho de que no se haya ofrecido como prueba en este debate dichos actos preparativos o insumos en los que se basó, no quiere decir que no existen y que solo fue un acto antojadizo y sin fundamento el que llevó a establecer dichas coordenadas, eso es algo que asume el licenciado Nombre14, y que no tiene respaldo en ningún elemento de prueba.” Aunque el alegato de la defensa no fue planteado adecuadamente, la argumentación del a quo no es procedente, ya que el que está anteponiendo el acto administrativo ante terceros, en este caso los imputados, como habitantes de Portete, es la autoridad judicial, no al contrario, por lo que es éste quien debe asegurarse sobre el alcance dentro del ordenamiento jurídico que tenga dicho acto administrativo utilizado.

Lo que se cuestiona no es la existencia del acto administrativo, ni la legitimidad que tenía el IGN para emitirlo, sino que el mismo haya sido una mero acto interno, el cual, como ya se explicó, no sería oponible a terceros, por lo que, lo que debió de utilizar la persona juzgadora es el Decreto Ejecutivo de 1980, originado de ese pronunciamiento ya indicado, si es que dicho decreto u aviso oficial existió, de lo contrario, no podría darle a dicho acto administrativo, una fuerza coercitiva que no tiene. Como tercer argumento para rechazar la actividad procesal defectuosa plantada por el licenciado Alvaro Enrique Moreno se indicó textualmente lo siguiente: “Tercero, si el Lic. Nombre14 o la defensa consideraba que ese acto administrativo era arbitrario y les generaba una afectación, lo que debieron hacer fue impugnar dicho acto, pero ante la sede correspondiente, sea, la Contenciosa Administrativa, donde se estudiara los antecedentes de dicho acto y eventualmente conseguir su nulidad, sin embargo, eso no se hizo y en consecuencia no hay razón alguna para que esta autoridad estime si quiera que pueda haber algo irregular con el mismo.

Tampoco lleva razón el a quo, puesto que quien debió de constatar que el oficio número 222, conforme lo estipula la Ley General de la Administración Pública, pudiera ser base para sus argumentos, y que éstos resulten válidos, era la autoridad judicial, quien precisamente debió asegurarse que el pronunciamiento emitido por el director del IGN, en 1980, hubiera sido legalmente publicado cumpliendo con el procedimiento que establece la ley, o la segunda opción, es que haya sido debidamente notificado como un acuerdo a los imputados, para así suponer que los sindicados, como administrados, no apelaron tal acto administrativo, mas no inferir lo que legalmente se desconoce y pese a ello, plasmarlo como un argumento válido en contra de los justiciables. En su cuarto argumento, el tribunal consideró que como dicho pronunciamiento se había emitido como complemento de la Ley 6043 de 1977, sobre la zona marítimo terrestre, al haberse producido dicho oficio tan solo 3 años después, se podría inferir que dicho acto se generó para concretar la excepción estipulada en el artículo 6 de la ley 6043 ya citada, por lo que no era un acto que se emitió para la época de este proceso, sea para el 2015, como para asumir que fue emitido con la única finalidad de causar un perjuicio a los sindicados, demarcando en forma sorpresiva hasta donde llegaba la ciudad litoral de Limón.

Afirmó textualmente el tribunal a folio 10 del legajo de apelación, lo siguiente: “ (…) Lo que a su vez quiere decir que si la defensa tuvo tiempo suficiente para impugnar dicho acto, dado que la presente causa inició en el 2015 y es hasta el 2021, que se efectuó el debate.” Desconociendo con ello, lo estipulado en la Ley General de la Administración Pública, que establece en el artículo 122, que los acuerdos como actos internos pueden ser utilizados por el administrado en su beneficio, mas no podrían ser opuestos en su perjuicio, lo genera la duda sobre si antes del año 2015, (en el que se generó un segundo oficio que como ya se indicó, que sí fue debidamente publicado en noviembre del 2015, mediante decreto ejecutivo, adquiriendo validez), existió o no un acto administrativo que haya tenido alcance general y que permitiera afirmar que éste complementara la Ley de 1961 ya citada, sobre si Nombre10 se encontraba dentro o no de la ciudad de Limón, porque dependiendo de tal situación, el tribunal de juicio puede concluir si la conducta acusada resultaría atípica como alega la defensa o por el contrario se estaría ante la posibilidad de que la conducta fuera típica, antijurídica, mas no culpable, ante la posible existencia de un error de prohibición invencible, tema que incluso será retomado en líneas posteriores.

Incluso con relación al alcance general del oficio número 222 del IGN, y sus repercusiones dentro del proceso penal, también cabe mencionar que tal y como lo afirmó el tribunal de juicio, el dictamen DCF 2015-1247-ING, de agosto 2015, a folio 536 y siguientes, basaron sus conclusiones en la utilización de las coordenadas emanadas del mismo oficio ya citado. Como quinto argumento, el tribunal rechazó que las delimitaciones de las ciudades solo pueden ser realizadas por ley. En realidad no lleva razón la defensa por los argumentos anteriormente expuestos en cuanto a la delimitación de los distritos y los entes facultados para hacerlo, pero en lo que se discrepa de lo planteado por el órgano decisor es que la ley de 1961, que otorgó una franja de 200 metros desde la pleamar, desde Nombre10 hasta el lugar conocido como 12 millas, incluyendo ambos terrenos dentro de la zona urbana de la ciudad de Limón, no resultaba aplicable a la Playa de Portete, y mucho menos a la excepción del artículo 6 de la misma ley.

En criterio del órgano resolutor, la defensa realizó una errónea lectura de la ley citada, porque aunque la ley comprende a Nombre10 como límite de la ciudad de Limón, ello no quiere decir que lo coloquen dentro de la excepción que comprende el artículo 6 de la Ley 6043, que incluso es una ley posterior. Para el tribunal de juicio a folio 10 del legajo de apelación, el artículo 6 ya citado indica textualmente: “(…) Las disposiciones de esta ley no se aplicarán a las áreas de las ciudades situadas en los litorales, ni a las zonas urbanas litorales…” y la ley 2906 indica que Portete, es límite norte de la zona urbana de la ciudad de Limón. Lo que se traduce en que las leyes utilizan términos diferentes, lo que no permite interpretar lo que la defensa pretende, ya que incluso la ley de 1961 no fue redactada para establecer una excepción planteada por una ley posterior, criterio desacertado, ya que independientemente de que una ley sea anterior a la excepción que fue creada después, lo cierto es que en nada afecta que una complemente a la otra, indistintamente de que no utilicen términos exactamente iguales, en el tanto se entienda lo que en esencia implica el contenido de las mismas, lo que basta con su simple lectura.

Tampoco resulta relevante para los alcances a probar en materia penal, el argumento esgrimido en el fallo de que en una Comisión en la Asamblea Legislativa que conocía de la ilegalidad de la construcción de un muelle en Portete, se llegó a la conclusión de que Nombre10 no era parte de la ciudad de Limón, puesto que para el caso subjudice, no es la Asamblea Legislativa quien debe definir tal aspecto, sino el tribunal de juicio. En lo que sí lleva razón el órgano resolutor, es que independientemente de lo anteriormente expuesto, no interesa si es el Consejo Municipal quien debe administrar dichos terrenos, para considerar que tanto el Ministerio Público como la Procuraduría General de la República tienen derecho a accionar en el presente proceso, el primero por tener el monopolio de la acción penal conforme lo establece el numeral 16 del Código Procesal Penal, y el segundo por representar los intereses del Estado y en defensa del patrimonio nacional conforme lo establece el artículo 3 de la Ley Orgánica de la Procuraduría General de la República, de forma que, lo que generó el vicio son los argumentos utilizados para desechar el criterio de que Nombre10 se encontraba fuera de la excepción del artículo 6 de la ley 6043, tomando en cuenta que no se explicó en sentencia si ese oficio utilizado como base de los principales argumentos, los administrados habían tenido legalmente la oportunidad de apelarlo, ya sea porque fue debidamente publicado por la vía correspondiente, o notificado a los imputados como para que se pudiera anteponer a los mismos los efectos administrativos de él generados y que fueron utilizados en materia penal en contra de la tesis de defensa de encontrarse ante la excepción ya explicada.

Con relación a la utilización de dicho oficio para determinar si las estructuras construidas en Nombre10 se encontraban dentro del área restringida o pública, en el dictamen criminalístico confeccionado por el perito Nombre14, número DFC 201-746-ING, a folio 220, y la ampliación 2015-1247-ING de página 536, vemos que el perito a folio 21 del legajo de apelación indicó que: “(…) si la memoria no me fallla en el mismo dictamen se indica, que la entidad encargada de amojonamiento, para sector ING, se consultó, me dijeron que para el momento no había, amojonamiento, ni físico, ni digital. Se consignó esa información y así consta en el dictamen pericial. La demarcación entre zona pública y restringida, la coloqué, por que para el segundo dictamen el registro a través del IGN, hace un comunicado y establece un amojonamiento digital en ese sector, se hace consulta de información y se logra obtener esa línea de amojonamiento digital que es indicada en esa ampliación o aclaración…” De lo declarado por el perito, podemos inferir que para la confección de los dictámenes mediante los que se dispuso que las viviendas se encontraban en parte área restringida y en parte en zona pública, se utilizaron coordenadas de un acto administrativo del que se desconoce dentro del expediente si había sido oficializado o no, del que tampoco se hizo constar si se había respetado el debido proceso a los administrados, ya sea mediante la publicación del mismo, o si por medio de la respectiva notificación a las partes, que es lo que hubiese permitido que los sindicados, hubiesen podido impugnar en caso de considerar que lo resuelto por la administración lesionaba sus intereses.

De allí la importancia de corroborar en un nuevo juicio de reenvío la validez de dicho acto administrativo. Como segundo vicio en la fundamentación, están los argumentos referidos a si las estructuras propiamente en las que detentaron los imputados, se encuentran dentro la zona o área restringida, la zona pública o la playa. La falta de exactitud sobre este tema, en la fundamentación del fallo, incide directamente en el segundo bastión de la resolución impugnada. Del análisis de la sentencia, se detectó una falta de concreción en el tema, puesto que, aunque se afirmó que las construcciones de ambos imputados se encontraban dentro de bienes de dominio público, ello no fue debidamente motivado. En primer lugar, al folio 36, el tribunal analizó la declaración del oficial del Organismo de Investigación Judicial, relato que adquiere especial relevancia, si se toma en cuenta que según lo declaró el perito Nombre14, él no conoció quien vivía en las estructuras de Playa Portete, sino que fue el oficial Nombre12 quien proporcionó la información sobre la identificación de las personas que detentaban las estructuras construidas en dicho lugar, incluyendo las casas de habitación que eran ocupadas por los dos justiciables, sobre las que el testigo a folio 28 del legajo de apelación refirió: “Las casas de Nombre03 y Nombre01 no pegan con el mar, desde ellas se ve el mar…”.

Afirmación que desmiente la realizada por el Ministerio Público y la Procuraduría General de la República, de que las construcciones que detentaban los sindicados y querellados estaban construidas en el espejo del mar o en la playa. Con relación a la ubicación de las casas de habitación dentro de la zona marítimo terrestre, el tribunal aseguró que las casas de habitación de los sindicados se encontraban dentro de la zona pública, y para ello citó el dictamen pericial 2015-1247-ING, a folio 536, como una de las ampliaciones generadas del dictamen 2015-746-IGN, el que el tribunal indicó a folio 36 en sentencia: “En él se puede apreciar la localización de cada una de las siete estructuras señaladas en las piezas acusatorias y la acción civil de esta causa, tanto del muelle, las bodegas, oficinas y casitas descritas por Nombre12. Propiamente a página 538 se aprecia un mapa de la zona de Portete, donde están marcadas cada una de las siete estructuras, además está delineada la zona marítima terrestre, tanto los 50 metros del área pública, como los 150 metros del área restringida, quedando claro que algunas de las estructuras referidas están dentro de la zona pública, y otras están en el espejo de agua, tal cual como lo refirió Nombre12 y el mismo perito“.

Del extracto citado se concluyó que el tribunal describió en formal general el contenido del dictamen, mas no lo analizó con relación específica a la situación de los dos justiciables, ya que, aunque en el lugar existan otras estructuras, las que interesan son las casas de habitación de Nombre03 y Lindo. La sentencia es un instrumento jurídico que debe valerse por sí sola, en la que no basta mencionar la prueba utilizada, sino que en el fallo debe de incluirse el análisis que le permite al tribunal llegar a una determinada conclusión. Se omitió indicar en el caso específico de ambos endilgados, dónde están situadas las casas de habitación dentro de los mapas de cada dictamen citado, a qué distancia de la pleamar están situadas en forma específica, ya que ello es el tema principal de la imputación, y con base en dicho análisis, entonces concluir si las mismas estaban en zona pública o restringida o en ambas, ya que de lo consignado en el fallo, se infiere que unas de las siete estructuras de Playa Portete, estaban en zona restringida y otras en zona pública, sin indicar mayor detalle específico sobre las de los acusados; además, debe citarse el lugar en que la información indicada se encuentra dentro de cada dictamen, información que fue omitida en sentencia.

Vicio que se agrava, si tal y como lo valoró el tribunal al final del folio 36 del legajo de apelación, al perito no le constaba quien detentaba cada estructura, sino que esa información fue proporcionada por el investigador judicial Nombre12. El tribunal se desgastó explicando la buena fe y preocupación del oficial judicial con relación de los acusados, sin explicar cual fue la información detallada que el testigo indicó específicamente de las casas de habitación de los encartados, y no de las estructuras en general. No se especifica en forma certera, a que distancia se encontraban cada una de las casas desde el espejo de mar o el pleamar. El tribunal insistió en que no se podía dudar de la información que brindó el oficial sobre la ubicación de cada estructura y de sus ocupantes, sin indicar cual fue exactamente esa localización y ubicación de las estructuras a las que esta haciendo referencia.

Posteriormente a folio 37 del legajo de apelación, se citó una serie de documentos emitidos por la Municipalidad de Limón para concluir que en la zona no se había concedido ningún tipo de permiso, lo que para el tribunal tenía especial trascendencia por que el oficial Nombre12 había dicho que algunas estructuras investigadas (sin indicar cuáles exactamente), se encontraban dentro del mar, o en el espejo de mar, sin que se explicara que relación tenía dicha información con el caso específico de los dos imputados, tomando en cuenta que el oficial judicial hizo referencia en juicio a todas las estructuras construidas en la zona de Portete, incluso describió un muelle, bodegas, construcciones que conforme a lo explicado en sentencia, no tendrían en principio ninguna relación con los endilgados, sino que pertenecían a los acusados que fueron sobreseídos en la presente causa, por lo que el tribunal no explicó la relación de dicho análisis con los imputados Nombre03 y Nombre01.

El tribunal continuó a folio 36 del legajo de apelación, analizando si el muelle construido en Portete, no contaba con ningún tipo de permiso ni para su construcción, ni utilización, sin explicar que relación tenía dicha estructura con las casas de habitación de los justiciables, la que al parecer era inexistente. Aunque esta cámara esta analizando únicamente aquellos argumentos por medio de los cuáles se acreditó la ubicación de las dos casas de habitación dentro de la zona pública, es evidente que en el fallo se hizo continuamente referencia a las “estructuras” para referirse en forma general a todas, sin concretizar en la mayoría de los casos, la ubicación y situación especifica de las casas de habitación de Nombre03 y Nombre01, sobre todo, porque en los croquis de cada dictamen pericial existente en el expediente, las estructuras están señaladas mediante número, es decir que el croquis o dictamen no está dirigido a analizar la situación únicamente de las casas de habitación de los encartados, sino de todas las estructuras existentes en la zona de Portete, lo que con mayor razón obligaba al tribunal de mérito, a realizar en la resolución el análisis ya indicado.

Estas pericias fueron retomadas en el análisis probatorio, a partir del folio 39 del legajo de apelación, en el que volvió el tribunal a cometer el mismo yerro, describiendo cada pericia y sus ampliaciones, iniciando nuevamente con la pericia DCF:2015-1247-ING, a folio 536, en la que se hizo referencia a que en éste dictamen si se pudo realizar la delimitación entre la zona restringida y la zona pública, así como se menciona el mapa o croquis a folio 538, el que se describió, indicando que en el mismo se contemplan las siete estructuras, explicando nuevamente que las construcciones en estudio se localizan en parte de la zona pública y de la pleamar, sin especificar, ni detallar a que distancia de la pleamar se encontraban las dos casa de habitación de los imputados, ya que para corroborar los hechos acusados en contra de los mismos, resulta esencial dejar claro en sentencia dichos aspectos.

Este yerro, se reiteró a folio 40, donde el tribunal analizó el resto de las pericias, en las que se explicó que la diferencia entre el dictamen anteriormente mencionado y el DCF:2017-682-ING, es que se cometió un error por parte del ingeniero Nombre14 en los puntos de referencia, sobre el que que afirmó el órgano resolutor, fue reconocido por el perito en debate, que en este último dictamen aparecen las estructuras dentro de la pleamar, cuando en realidad debería ser como lo establecía el dictamen DCF: 2015-147-ING, en el que se concluyó que las estructuras estaban dentro de la zona pública y la zona marítima terrestre, sin especificar, si lo que había sido ubicado como la propiedad que detentaba cada imputado se encontraba en su totalidad construido, o solo una parte del lote, tampoco se aclaró si lo que se encontraba en zona pública es la propiedad y la casa en área restringida, o viceversa, o, si era que la construcción está en medio de las dos zonas, porque nada de eso se analizó ni se explicó en la resolución recurrida, lo que generó un vicio de fundamentación.

Luego se describió a folio 40 del legajo de apelación, el dictamen DCF:2016-2230-BIO a folio 992, que el mismo tenía fotografías de las estructuras investigadas y un mapa del área, sin que nuevamente el tribunal analizara o al menos describiera la ubicación exacta de las casas de habitación, y con relación al dictamen DCF: 2017-00583-BIO, se explicó que se encontraba a folio 1052, pero nuevamente no se analizó con detalle, únicamente se indicó que ambos no aportaban mayor información de interés para la resolución de la causa. Se hace ver que aunque el tribunal juzgador debe basarse en los peritajes y demás probanzas en el expediente, no es el perito quien determina la existencia de un posible delito, sino el tribunal juzgador, por lo que no basta con que el ingeniero califique que una determinada estructura se encuentra en zona pública, sino que el tribunal debe de analizar tales pericias con detalle, sobre todo cuando todos estos peritajes fueron incorporados dentro del debate, y además utilizados por las partes, en el interrogatorio al perito, valoración que resulta necesaria con el fin de poder tener por acreditado la ilicitud acusada, con relación a cada casa de habitación por separado, sin hacer referencias genéricas.

En el caso de que el peritaje no resulte específico, se ha de explicar con base en qué prueba complementaria adquirió la certeza de que los sindicados detentaban casas dentro de la zona pública, y que sus casas estaban ubicadas a menos de 50 metros de distancia de pleamar, con el propósito de que sea el tribunal quien determine la existencia o no del delito acusado, incluyendo no solo la descripción del elemento probatorio, sino el análisis de cada probanza puesta bajo su conocimiento y que le permitió llegar a determinada conclusión. No es posible que en todo el fallo, no se halla incluido la ubicación o localización específica de cada construcción en la Playa de Portete, y la distancia de cada una de ellas con relación a la pleamar, ya que incluso el investigador judicial, sin referirse en forma exacta a alguna de las siete estructuras, sí explicó que algunas de ellas se encontraban en el mar o lo que el testigo llamó como espejo de agua, y que en el caso de las casas de habitación de los imputados, estas no estaban en el mar, pero desde ellas sí se lograba ver el mar.

Debe aclararse que lo que se cuestiona en esta instancia, no es la posibilidad de utilizar un amojonamiento virtual, a efectos de determinar las coordenadas que sirvan de límite de la ciudad de Limón, lo que legalmente como líneas atrás se desarrolló, el Instituto Geográfico Nacional está facultado para hacer, sino, la falta de publicación del aviso, lo que impide que dicho acto administrativo sea oponible a terceros, es decir a los sindicados; lo que con base en el propio análisis de sentencia sí se realizó con el oficio 2015-11, en el que se publicó los límites de la ciudad de Limón, incluso después de haber realizado el amojonamiento físico, acto administrativo que fue publicado conforme se establece a folio 723 en el informe enviado a la Asamblea Legislativa por parte del Director Max Lobo, en el que se indicó que la delimitación de Portete, fue publicada mediante aviso 2015-11, publicado en La Gaceta número 222 del 16 de noviembre de 2015 sobre “Delimitación de la Zona Pública de la Zona Marítimo Terrestre en Bahía Portete, desde el Límite de la Ciudad de Limón en Nombre10 siguiendo río oeste hasta el mojón 500- de Limón”, amojonamiento que se realizó durante el transcurso de la investigación de los presentes hechos.

Este aviso oficial fue publicado en noviembre del 2015, para cuando los detentadores de las estructuras de Nombre10 ya no se encontraban habitando las estructuras ya que habían sido desalojados del lugar, ante el ordenamiento de una medida cautelar, que según lo indica la propia acusación, en el hecho segundo, fue ordenada por el Juzgado Penal de Limón, en agosto del 2015, momento en que las edificaciones fueron puestas en custodia del Servicio Nacional de Guardacostas, todo lo que debió ser analizado en sentencia, relacionado con la fecha en el que el aviso número 222 de setiembre de 1980, fue debidamente publicado en el diario oficial y no como se hizo en la resolución conforme a la fecha de creación del aviso, como se analizó en sentencia. Con relación a la fundamentación de la existencia de un error de prohibición. Ante los dos supuestos fácticos planteados, con relación al oficio de ING del año 1980, resultarían conclusiones muy diferentes, puesto que si no existiera ningún acto administrativo de alcance general emitido antes del año 2015, la conducta de los imputados sería atípica, porque legalmente como referencia sobre la posible existencia de Nombre10 como parte de la ciudad de Limón, solo se tendría la Ley de 1961 ya citada, mientras que en caso de que dicho pronunciamiento de 1980, se haya oficializado mediante publicación en el diario oficial, la conducta resultaría típica, antijurídica pero no necesariamente culpable, ya que además de los argumentos citados por el tribunal, se ha de analizar que conforme se indicó en sentencia, el dictamen DCF: 2015-746, a folio 220, de mayo del 2015, dejó claro que para esa fecha no se podía delinear la zona marítima terrestre, en razón de que el IGN informó que no había amojonamiento físico en la zona, situación que fue corregida posteriormente, tanto que para el mes de noviembre del año 2015, se oficializó el aviso 2015-11 en el que se indicó los límites de la ciudad de Limón, excluyendo Portete.

Lo anterior, genera la disyuntiva de que, aún en el supuesto de que hubiese existido la publicación en el diario oficial del amojonamiento virtual realizado en el año 1980, no existía un amojonamiento físico en la zona de Portete, por lo que no era factible que los sindicados pudieran conocer que se encontraban violentado las diposiciones de la Ley 4063, ya que como Nombre10 no era parte de la ciudad de Limón, terrenos de la zona, en los que se encontraban sus casas de habitación, se le aplicarían las disposiciones de la zona marítimo terrestre. Con relación a los alegatos del Ministerio Público y la Procuraduría General de la República, en cuanto a que no se podía considerar que los justiciables se encontraban ante un error de prohibición invencible, porque aún y cuando creyesen que el artículo seis los protegía, por considerar que Nombre10 estaba dentro de los límites de la ciudad de Limón, alegan que las estructuras con base en la prueba, se encontraban en la playa.

Se alega que los litorales costarricenses poseen una zona pública inalienable de 50 metros, sin importar si se encuentra en una ciudad portuaria, pues en su criterio la excepción del artículo seis de la ley 6043, está referida únicamente a la inexistencia de la zona restringida de las ciudades enlistadas en la propia ley. Aunque no se cita ninguna normativa al respecto, el Ministerio Público sustenta su afirmación en la declaración del testigo Nombre13, quien es funcionario municipal, y funge como inspector de la zona marítimo terrestre -a quien el recurrente consideró experto en el tema-, y el representante de la Procuraduría General de la República en la declaración del oficial Nombre12. Tal y como lo exponen ambos recurrentes, el artículo 70 de la Ley de Zona Marítimo Terrestre, establece que las personas que ocupaban los territorios que ahora son zona marítimo terrestre, y que tenían 10 años de ocupar terrenos, que después de emitida la ley son terrenos considerados parte de la zona marítimo terrestre, podrán continuar en posesión de sus respectivos lotes y deberán respetar la zona pública.

Sin embargo, del contenido de dicha norma, no podría extraerse la afirmación sostenida por ambos recurrentes; primero porque el artículo es muy claro en referirse a terrenos que después de pronunciada la ley, serían considerados zona marítimo terrestre, es decir, que no se está refiriendo a las propiedades dentro de las ciudades costeras, sobre todo cuando el artículo seis de la misma ley citada indica textualmente: “Las disposiciones de esta ley no se aplicarán a las áreas de las ciudades situadas en los litorales, ni a las zonas urbanas litorales, ni a las propiedades inscritas, con sujeción a la ley, a nombre de particulares, ni aquellas cuya legitimidad reconozcan las leyes.” (Así reformado por la Ley Marco para la declaratoria de zona urbana litoral y su régimen de uso y aprovechamiento territorial, número 9221 del 27 de marzo del 2014). Lo que implica que, a los terrenos dentro de las ciudades costeras como Limón, no se le aplicarán las disposiciones establecidas en dicha ley en su totalidad.

Además, se tendría que analizar, para el caso concreto, lo dispuesto en el artículo 8 de la Ley 2121 del 27 de marzo del 2014, Ley Marco para la Declaratoria de Zona Urbana Litoral, en el que se indica que dentro de las zonas urbanas litorales se podrá otorgar concesiones, de conformidad con lo dispuesto en la presente ley y en el plan regulador urbano de la respectiva localidad. Este numeral en su párrafo segundo, tercero y cuarto textualmente indican: “Quedan excluidos, de lo dispuesto en el párrafo anterior, los terrenos que se presenten espacios abiertos de uso común, aquellos que posibiliten el libre acceso a la costa, aquellos afectos a un régimen de patrimonio natural del Estado, aquellos que no correspondan al demanio público y aquellos ubicados en los 50 metros contiguos a la pleamar ordinaria que no hayan sido objeto de ocupación antes de la entrada en vigencia de esta ley. -Las concesiones que se otorguen en los 50 metros contiguos a la pleamar ordinaria estarán condicionadas a que no se modifique el uso ni se amplíe la densidad de la construcción que tenía el terreno antes de la entrada en vigencia de esta ley, siempre y cuando tales condiciones hayan sido avaladas por el plan regulador urbano y no incumplan la normativa ambiental vigente.

Los municipios cuya jurisdicción incorpore zonas urbanas litorales deberán garantizar el libre acceso a la costa y el disfrute de la playa a toda la población. Sin perjuicio de las labores que ejecuten otras instituciones del Estado para dicho propósito”. Este artículo, permite considerar que, dentro de las ciudades costeras, no es cierto que se deba de respetar los 50 metros de pleamar, sino que será revisado en este caso por cada municipio, la concesión para que la construcción anterior a la ley del año 2014, permanezca dentro de la zona pública de los 50 metros de pleamar, exceptuando los casos en este numeral citado. Con base en la declaración del oficial Nombre12 en debate, citado incluso por los recurrentes, aunque en Nombre10 haya casas en el espejo de mar, las casas de los imputados no estarían en tal circunstancia, ni tampoco dentro de la playa, sin embargo, con base en la fundamentación del fallo, resulta imposible llegar a tal conclusión, ya que no se fundamentó la misma sobre dicho extremo, al no indicarse la distancia en que se encontraba las casas de habitación de los imputados y no las otras estructuras, no es posible con la lectura de la sentencia, extraer de las consideraciones del tribunal con relación a si las casas de habitación de los sindicados, que se determinaron en sentencia como ubicadas en la zona pública, estarían localizadas, o al menos alguna de ellas, específicamente en el espejo de mar o en la playa.

Aspecto que resultaría de interés a efectos de poder determinar si se estaría ante un error de prohibición invencible, una vez descartada la atipicidad de la conducta, por los criterios anteriormente esbozados, todo con apego a lo dispuesto en el artículo 8 de la ley 9221 ya indicada, que concede dependiendo del caso, el uso de construcciones y habitaciones dentro de la zona pública dentro de las ciudades costeras. Aún y cuando los argumentos utilizados para aplicar un error de prohibición invencible, fueron inicialmente válidos, ello no permite obviar los vicios anteriormente citados y que obligan a declarar la ineficacia de la sentencia, ya que los efectos de una absolutoria por atipicidad o por error de prohibición invencible, tienen consecuencias civiles diferentes, lo que obliga también a declarar la ineficacia de lo resuelto en cuanto a las consecuencias civiles de la sentencia. Con relación a la participación de terceros civilmente interesados.

En la etapa intermedia, algunos imputados fueron sobreseídos, sin embargo, con base en la lectura del Auto de Elevación a Juicio, estas personas podrían ser consideradas como terceros civilmente interesados, ya que el juez penal, mediante resolución del 20 de mayo del 2019, incorporado en el expediente virtual a las 14:49:79, dejó vigente la medida cautelar de desalojo de todas las construcciones existentes en Portete, medida cautelar, que, conforme a la acusación, fue realizada en agosto del año 2015. De allí que, conforme al artículo 121 y 124 del Códdigo Procesal Penal y ante una nueva sustanciación, los terceros civilmente interesados podrán solicitar, su intervención en la etapa de juicio, ya que fue en el Auto de Elevación a Juicio, en el que se mantuvo vigente la medida cautelar ordenada anteriormente, resolución del que surgió su derecho, y su vinculación al proceso, quienes evidentemente podrán gestionar que se les tenga legalmente constituidos dentro del proceso penal como terceros civilmente interesados, y en esa condición, intervenir en el proceso.

Dicha posición es avalada por la Sala Constitucional, en las resoluciones números 5447 de las 16:57 horas del 4 de octubre de 1995, en igual sentido el voto No. 4121 de las 16:51 horas del 13 de agosto de 1996, en las que se dispuso que los terceros civilmente interesados, podrán aportar prueba y ser escuchados durante el juicio. Así ha sido reconocido al tratar el problema del comiso y la afectación a terceros propietarios, consideraciones que se aplican de igual forma en el caso de análisis, toda vez que en la resolución número 5447 ya citada se indicó que: “Recaída sentencia, si ésta ordenare el comiso, debe entenderse que se dió oportunidad de defensa y audiencia a los terceros propietarios o poseedores de los bienes y no partícipes en el delito juzgado, que pudieran verse afectados con la medida, de conformidad con los artículos expuestos, que si bien no prevén expresamente un determinado procedimiento de traslado o apersonamiento del tercero, por imperativo de la propia Constitución Política y los principios fundamentales que la inspiran, contemplados básicamente en los numerales 39 y 41(...) el juzgador deberá, en la medida de lo posible, estructurar con los elementos procesales que cuenta, la forma de dar esa audiencia previa al tercero que pueda verse afectado, pues no podría pensarse en un despojo que opere de pleno derecho, o en una decisión que afecte derechos o intereses legítimos de una persona, sin haber sido ésta siquiera oída, sobre todo cuando se expone su propiedad a una disminución que casi operaría de pleno derecho aplicando en forma automática las disposiciones relativas al comiso y confiscación, práctica que resulta inconciliable con los derechos fundamentales de defensa y de audiencia a que se ha hecho mención.

Aún y cuando los terceros civilmente interesados, podrán acudir a la vía civil no solo para hacer valer sus derechos, sobre todo, cuando sea posible, reclamar la indemnización de cualquier daño causado, la jurisprudencia constitucional ha dispuesto que ante la posibilidad de que estos terceros civiles puedan ser despojados de algún derecho de posesión, tendrán derecho a participar en el proceso penal, lo que resultaría aplicable en el presente caso, cuando incluso en sentencia, se podría ordenar la destrucción definitiva de las edificaciones sobre las que alegan tener derecho, dependiendo de las resultas del proceso. Con base en lo anterior, se declara la ineficacia de la sentencia, se ordena el reenvío del expediente al despacho de origen, para que, con una integración diferente, se realice una nueva sustanciación.

IV. En virtud de lo resuelto, carece de interés el resolver el resto de las disconformidades e impugnaciones presentadas

POR TANTO:

Se declaran con lugar los recursos de apelación presentados por el licenciado José Alejandro Alpízar Arrones en representación del Ministerio Público; del licenciado Andrés Alfaro Ramírez en representación de la Procuraduría General de la República; y el recurso de apelación presentado el licenciado Álvaro Enrique Moreno Gómez en representación de los imputados Nombre02 y Nombre01. En consecuencia, se declara la ineficacia de la sentencia impugnada en su totalidad, se ordena el reenvío del expediente al despacho de origen, para que con una integración diferente se realice una nueva sustanciación. Por carecer de interés, por la forma en que se resuelve, se omite pronunciamiento del resto de los motivos presentados en las diversas impugnaciones.
