Goicoechea, at eight fifteen a.m. on dieciocho de febrero de dos mil veintidós.- Judicial proceedings to determine fair compensation (justiprecio) in an expropriation, brought by the Instituto Costarricense de Acueductos y Alcantarillados (AYA), represented by its special judicial attorney-in-fact Ana Victoria Sánchez Villalobos, against the Asociación Pro Hospital Nacional de Niños, represented by its President, Nombre162464, identification card number CED126629. The Instituto Costarricense de Electricidad is also a party.- Attorney Luis E. Sibaja Guillén appears as special judicial attorney-in-fact for the expropriated party. On appeal by the expropriated party, this Court reviews the first-instance judgment, N°1279-2021-E issued at 14:03 hours on 24 de junio de dos mil veintiuno, clarified by the ruling issued at 10:58 hours on 21 de setiembre del 2021. The matter is decided unanimously, after hearing the parties.- Judge Aragón Cambronero drafts the opinion, and
WHEREAS:
I).- PROCEDURAL MATTERS: The Instituto Costarricense de Acueductos y Alcantarillados brings these proceedings to establish the price it must pay the Asociación Pro Hospital Nacional de Niños for the creation of two sanitary sewer and right-of-way easements (derechos de servidumbre de alcantarillado sanitario y de paso) over two strips of land measuring 8.551,00 and 107,00 square meters, as well as for the subdivision (segregación) of a lot having an area of 12.135,00 square meters from a property that it owns, which is located in La Uruca, is recorded in the Registro Público under real-property folio registration number Placa33226 of the Partido de San José, has cadastral plan (plano catastrado) Placa33227, and has a total area of 336.945,99 square meters. To construct an outfall sewer (Emisario) that is an integral part of the Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José, AyA needs to partially expropriate this land and create the aforementioned easement rights. The expropriated party objected to the administrative appraisal (avalúo administrativo). Following the requisite proceedings, Judge Billy Araya Olmos, in judgment N°1279-2021-E issued at 14:03 hours on 24 de junio de 2021, ordered:
"POR TANTO: On the merits of the foregoing, and based on the preceding findings of fact and conclusions of law, anything not expressly granted shall be deemed denied; the financial offer contained in the administrative appraisal prepared by the AyA Unidad Ejecutora, N° PREP-PAPS-2018-02246 dated 11 de junio de 2018, amounting to ¢362.266.058,oo (THREE HUNDRED SIXTY-TWO MILLION TWO HUNDRED SIXTY-SIX THOUSAND FIFTY-EIGHT COLONES), IS AFFIRMED. This compensation comprises the following items:
The ruling was corrected by an order issued at 10:58 hours on 21 de setiembre del 2021, which provided:
“(…) Pursuant to Article 220 of the Código Procesal Contencioso Administrativo and Article 63 of the Código Procesal Civil, the clerical errors contained in the ruling issued at catorce horas y tres minutos del veinticuatro de junio de dos mil veintiuno are corrected so that: a. under the section "SECOND.- PROVEN FACTS," in paragraph 8°-), when itemizing the value of easements 1 and 2 and the land to be expropriated, in the subsection "2) The value of easement 2," where it refers to the value of the damage to the remantente (sic); b. under the section SIXTH.- CONFIRMATION OF THE FINANCIAL OFFER (page 33 of the judgment); and c. at the end, in the operative portion thereof, instead of "¢104.993.000,00 (one hundred four million nine hundred ninety-three thousand colones)," it shall correctly read: "¢104,993.00 (one hundred four thousand nine hundred ninety-three colones)." (image 32 of the appellate record).
Dissatisfied with that judgment, the attorney-in-fact for the expropriated party filed a timely and proper appeal, which was admitted, and it is therefore analyzed below.- II).- PROVEN FACTS: The facts stated as such in the appealed judgment are approved because they are consistent with the evidentiary elements cited in support thereof. Nevertheless, fact number 8, subsection 3), is supplemented as follows: In calculating the damage to the remainder, the Before-and-After methodology (metodología del Antes y Después) was used, stating: “which may be seen in the Calculation Annexes,” and setting the value under this item at zero colones. (The evidentiary support is identical to that cited in the appealed ruling). The following proven facts are added: 15).- In Anexo 8 of the administrative appraisal prepared by the AyA Unidad Ejecutora, N°PREP-PAPS-2018-02246 dated 11 de junio de 2018, corresponding to the calculation worksheets, the following was stated: “According to the calculations performed, the value per square meter of the property increases after the subdivision, mainly because of the greater regularity acquired by the property, since a ‘small tail’ of the property is being eliminated, which previously had an adverse effect on its regularity, increasing from a factor of 0.836 to 0.896.
Another factor that increases the value per square meter is the area ratio, because the area of the property decreases, and therefore the ratio relative to the properties used for comparison (propiedades a homologar) tends to increase. Now, by calculating the difference between the Before and After values of the property, we obtain: ¢11 132 614 477, 06 - ¢12 023 383 382.00 = -¢890 768 905.16. The resulting value is negative, which indicates that no compensation for damage to the remainder should be paid, because when the area shown on plan SJ-1631901-2013 is subdivided from the property, the property acquires a more regular shape, which helps increase the resulting value per square meter and consequently produces a higher total value. (Anexo 8, images 336-337 of the main electronic case file). 16) On the expropriated land, the expropriating party installed two culverts with diameters of 106 and 45 centimeters respectively, which allow water from the remaining area to drain.
(According to report PRE-PAPS-2019-01658 and the photographs in images 162, 163, and 164 of the main electronic case file).- III).- UNPROVEN FACTS: The list of facts deemed unproven is approved because it reflects the evidentiary record contained in the case file; the following is added as an unproven fact: 3)- That the subdivision of the 12135-square-meter lot described in cadastral plan SJ-1631901-2013 adversely affects the Asociación’s actual and current activities and the property’s economic prospects, including the remaining area. (The record is silent in this regard).
IV).- APPEAL BY THE EXPROPRIATED PARTY. In summary, counsel for the expropriated Asociación states in his brief dated 20 de setiembre del 2021 that the lower court’s analysis regarding the absence of damage to the remainder (daño al remanente), and the resulting denial of compensation, is erroneous. He argues that none of the administrative appraisals (avalúos administrativos) identified the existence of such damage to the expropriated lot or land. He states that the expropriation of easements (servidumbres) 1 and 2 is not part of this appeal and that his objections therefore do not extend to them, but relate only to the expropriation of the 12135-square-meter parcel, pursuant to cadastral plan SJ-1631901-2013, which lies between Río Nombre8875 and the remainder. He asserts that, in 2009, a stone channel was built to prevent water from becoming trapped on the land, as had previously occurred; the channel conveys the water to Río Torres, and the property now being expropriated lies in between.
He warns that, once the property is registered in the name of AyA, AyA will have no obligation to receive the water, which is the source of the damage to the remainder. He asserts that the expropriated strip of land served as a drainage route for stormwater conveyed toward Río Torres from the neighboring and adjoining property (impermeable land because it consists mainly of stone); as a result of the expropriation, maintaining that conveyance becomes impossible, thereby turning the remainder into a hydraulically landlocked parcel (fundo enclavado hidráulicamente), since the water will have to be discharged by other means. He states that this was established by the expert assessment (peritaje) of Ing. Fernando Peñaranda in his various reports. He contends that the economic prospects of the remainder have been adversely affected. He argues that compensation must be paid for the losses caused to it as owner of property 1-465031-000; the segregated parcel is N° 1-670386-000.
He insists that the report by Nombre163406. analyzes the stormwater and water-related problem affecting the remainder, whereas the administrative appraisals did not, and alleges a violation of articles 22.1 of the Ley de Expropiaciones and 3 of Ley 6313. He argues that, in the reports from 2013, 2015 and 2019, Nombre163406. consistently affirms the existence of damage to the remainder; the judge failed to conduct a fair and reasonable analysis of these expert reports, thereby denying him a proper defense, and he alleges a violation of the rules of sound judicial assessment (reglas de la sana crítica) in the evaluation of the technical evidence and the judicial inspection (reconocimiento judicial). During the oral appellate hearing held on 05 de noviembre del 2021, he expressed his disagreement with the lower court’s analysis regarding the absence of damage to the remainder, which he described as erroneous.
He argued that none of the administrative appraisals recognized this damage and that, consequently, no compensation was awarded for it; this is the crux of the matter. Indeed, he emphasizes that, in an order issued at 14:15 hours on 16 de mayo del 2018, the trial judge ordered the initial administrative appraisal to be corrected and required an explanation of why compensation for damage to the remainder was not warranted. Nevertheless, he contends that this order was not complied with, because in the appraisal dated 11 de junio del 2018 the Administration merely stated that the value was zero. He insists that this is an impermeable parcel requiring drainage and that the expropriation makes it impossible to convey the water to Río Torres, thereby turning it into a hydraulically landlocked parcel. He emphasizes that the water will have to be discharged differently from the way it is currently discharged; none of this was addressed in the administrative appraisals, whereas it was explained by Ing. Fernando Peñaranda in his reports, particularly in the final report dated 04 de abril de 2019, in which he expressly recognized the existence of damage to the remainder, caused primarily by the drainage of water, without having to depend on the expropriated party’s goodwill, as he had already stated in a memorandum dated 12 de setiembre del 2013.
He states that the Asociación’s current, actual activities and the property’s economic prospects, including both the remainder and the expropriated area, have been adversely affected. He considers erroneous the reasoning in the appealed judgment concerning the lack of evidence of any impediment to discharging the water through the A y A parcel. He states that the channel was built before the expropriation proceedings; the expropriating party has stated that the property’s conditions have not changed and submitted photographs for that purpose, demonstrating that there is no barrier preventing stormwater drainage. This was stated in memorandum PAPS-2019-01658 dated 13 de mayo del 2019; the position expressed therein was endorsed by the lower court in the appealed judgment, which even cited it, as grounds for denying compensation for damage to the remainder. He argues that the court erred because the problem lies in the loss of the right to convey the water to Río Torres, which is compensable and could be affected in the future once this case is closed, since the Administration, upon becoming the owner of the property, could prevent the conveyance of water.
He argues that, as of AYA Board of Directors Resolution number 2013-231 dated 28 de mayo de 2013, his client lost the actual ability to convey the water through the channel; this is when the uncertainty arose and the right to compensation came into existence. He emphasizes that the related memorandum PAPS-2019-01658 establishes that the possibility of allowing the water to be discharged will depend on authorization from the owner of the parcel in question. He argues that the damage could be avoided only by imposing an easement—as initially requested—or by awarding compensation for damage to the remainder, all of which was assessed by the court-appointed expert (perito judicial), Nombre163406. He warns that the lower court failed to conduct a fair and reasonable analysis of the court-appointed expert’s appraisals, did not apply the rules of sound judicial assessment, and did not evaluate the evidence as a whole, disregarding the assessment of the aforementioned expert; he invokes articles 22.1 and 03 of the Ley de Expropiaciones.
He alleges that the expropriated party was denied a proper defense because the court-appointed expert’s reports were not analyzed and the compensation to which it is entitled for damage to the remainder was denied. The judge failed to consider that the water is conveyed through the channel built in 2009 for that purpose. He emphasizes that the lower court took advantage of the inaction of the third tie-breaking expert (perito tercero en discordia), which resulted in that expert’s assessments not being considered. He therefore deems it necessary to obtain an opinion from a third tie-breaking expert, which he offers at this stage as evidence to assist adjudication (prueba para mejor resolver), or alternatively a privately commissioned expert assessment. He requests that the appealed decision be reversed and that compensation for damage to the remainder be set in accordance with the terms stated by Nombre163406.
Regarding the use of the land at the time of the expropriation, he clarified that it had no particular use; he stated that it is a quarry area that Parque de Diversiones has used for outdoor events, and that the land is located in the western sector of Parque. He added that the compensable damage consists of the loss of the right to convey the water received by the parcel. To date, the expropriating institution has allowed the water to be conveyed, but that right will be lost in the future; this constitutes actual and present damage because the parcel lacks access to Río Torres. The loss suffered by the property owner is precisely the loss of the right to continue conveying the water.
V).- ARGUMENTS OF THE EXPROPRIATING ENTITY. For its part, the Instituto’s representative argued that the appealed judgment is consistent with the law. The representative addressed the nature of a landlocked parcel (fundo enclavado), which, pursuant to sections 395 et seq. of the Código Civil, requires the establishment of an easement right. The representative notes that the party alleges the existence of a hydraulically landlocked parcel, a concept the representative did not find in the relevant literature; however, the representative did locate the so-called natural easement (servidumbre natural), regulated by article 94 of the Ley de Aguas. The representative emphasizes that an easement in favor of a private party cannot be established a priori over property in the public domain (bien demanial). The representative states that Nombre5630 has accepted the conveyance of water through the existing channels for both the expropriated land and the remainder and, indeed, has improved the channels and drainage outlets.
In fact, when the outfall pipeline (emisario)—an aboveground pipe supported by large concrete bases—was built, an enormous stormwater culvert was constructed beneath it to allow the water to be conveyed easily. This is documented in the court record through photographs clearly showing how the outfall pipeline was constructed. The representative argued that the obligation to dispose of stormwater rests with the owner of the parcel receiving it, as provided in articles 04 and 94 of the Ley de Aguas and 285 of the Ley General de Salud. There is no right to convey the water once the property passes into the hands of A y A, and the opinion of the Contraloría General de la República will therefore be required before any encumbrance may be imposed. In support, the representative invokes the opinion of the Procuraduría General de la República, C-154-2003 dated 02 de junio del 2003, which analyzes circumstances similar to those alleged.
The representative states that the outfall pipeline has been in place for 05 years and that no problem with the conveyance of water has arisen. Regarding the court-appointed expert assessment, the representative insists that it must concern the review of the administrative appraisal pursuant to article 22 of the Ley de Expropiaciones, without considering future or uncertain damage; in this case, the court-appointed expert relied on assumptions and mere speculation. The representative states that the party most interested in ensuring that the water is properly discharged is A y A, which is subject to special rules in that regard. In this case, under the before-and-after valuation methodology (metodología de valoración del antes y el después), the remainder actually increased in value because removing the strip along the riverbank eliminated the disadvantages associated with it. The representative states that article 17 of the Ley de Expropiaciones is likewise inapplicable.
The representative asserts that the second administrative appraisal increased the value of the remainder because it was a smaller lot and that the segregation made its shape more regular; this remaining portion of the property suffers no damage whatsoever. As for the impermeability of the soil, it is not a consequence of the expropriation but an inherent condition of the land. The representative insists that its client has not interfered with the conveyance of water; if this should occur in the future, recourse must be had to the procedural avenues provided by the legal system (Ordenamiento Jurídico). The representative opposed the technical evidence offered to assist adjudication and requested, as evidence to assist adjudication, that a judicial inspection be conducted.
VI).- EVIDENCE TO ASSIST ADJUDICATION: In this case, during the oral hearing held on 05 de noviembre del 2021, both parties offered evidence to assist adjudication: the appellant requested the appointment of a third tie-breaking expert or, alternatively, a privately commissioned expert assessment, while the representative of the expropriating entity requested a judicial inspection of the parcel that is the subject of this expropriation. It is placed on the record that both items of evidence were orally denied during the appellate hearing, as reflected in the audio recording thereof included in the electronic case file under the appeals folder.
VII).- ON THE MERITS OF THE APPEAL: In order to define the jurisdiction of this Chamber in hearing the appeal filed by the representative of the expropriated party, it is essential to note that the objections were specifically directed at the Trial Court’s ruling insofar as it denied compensation for damage to the remainder. According to the appellant, that damage results from the severance of the 12 135-square-meter strip of land described in cadastral plan SJ-1631901-2013, which, it is alleged, leaves the remainder of the property owned by the Asociación as a hydraulically landlocked parcel (fundo hidráulicamente enclavado), for which the appellant seeks compensation; the appellant expressly agreed with all other aspects of the challenged judgment. Accordingly, it is essential to set forth the findings of the court below (a quo), which, as relevant here, held:
SIXTH.- CONFIRMATION OF THE FINANCIAL OFFER. Prima facie, it is important to mention that this Court, by means of the ruling issued at 08.42 hours on 22 de febrero de 2019, vacated the appointment of the third court-appointed expert (perito judicial), Engineer Luis Amadeo Alvarado Boirivant, who failed to provide his technical opinion regarding the new administrative appraisal (avalúo administrativo) issued by the AyA Executing Unit. At the same time, the parties were given an opportunity to state whether they required the appointment of another dissenting expert (perito en discordia); neither party submitted such a request before this Court. - For the present, the central issue in determining the compensation (indemnización) in these proceedings concerns, in short, the alleged damage to the remainder (daño al remanente), in view of the partial expropriation (expropiación parcial) of the parent property (finca madre) F.R. 1-465031-000, a parcel of land measuring 12.135,00 m², according to cadastral plan (plano de catastro) SJ-1631901-2013.
However, the expropriated legal entity (persona jurídica expropiada) never proved that AyA had denied the right to drain stormwater from the property owned by Asociación Pro Hospital de Niños, F.R. Placa33228, which arose as a consequence of a legal act undertaken motu proprio by the expropriated party during the processing of these proceedings before this Court. In other words, the expropriating public entity (ente público expropiante) has at no time denied the drainage of water originating from natural sources, much less prevented stormwater from flowing freely along the course it would naturally follow upon reaching the site of the outfall-pipe works; this is because that pipeline is above ground and in no way restricts the free passage of rainwater. Without question, the dispute in the case at bar (sub lítem) centers on this key point, since the values assigned by AyA both to the real easement rights (derechos reales de servidumbre) and to the respective damage to the remainder were endorsed by Nombre163406. , whose expert report (pericia), it bears repeating, is the only one in the record, because the appointment of the third dissenting expert was revoked—as stated above—after he failed to provide the technical opinion required by the presiding judge concerning the new administrative appraisal.
Accordingly, Nombre163406. stated that AyA had not included a right of outlet for the rainwater that flows by gravity across the property. Additionally, he asserted that the expropriating entity failed to assess the future cost of measures for draining this water should it become necessary to remove it by artificial means (storage tanks and pumping systems). In that context, the professional is incorrect, because he makes the compensation that he assumes is warranted for damage to the remainder as a consequence of the expropriation contingent upon a future and uncertain event, namely, the alleged improvements needed to drain the water falling on the property, which does not even form part of the subject matter of the proceedings sub judice: property F.R. 1-670386-000, subdivided (segregada) from the parent property to be expropriated (F.R. 1-465031-000). In other words, the court-appointed expert does not even begin to quantify the actual and permanent damages, as required by sections 2, p. 2° and 3 of Ley 6313 del 04 de enero de 1979, in conjunction with article 22 in fine of the Ley de Expropiaciones, Ley (No. 7495) de 3 de mayo de 1995, published in Alcance No. 20 to La Gaceta No. 110 de 8 de junio de 1995.
Neither he nor the expropriated party is correct in claiming that AyA does not guarantee a right of passage for rainwater, namely natural runoff (escorrentía natural) or runoff resulting from development of the land; nor are they correct in speculating that a “property hydrologically landlocked” (“fundo pluvialmente enclavado”) would be created because of the alleged impossibility of draining its water naturally. Nor may it be asserted that the expropriated party will eventually have to invest in costly systems that are difficult to operate for the disposal of such water. Note also the informal nature of the opinion expressed by the court-appointed expert, who assumes that it was impossible to quantify the value of the works and equipment needed to drain the water by “pumping” until a detailed hydrological study of the tributary basin is conducted to establish runoff flows. His statements are plainly highly contradictory, insofar as he also asserted that this solution—improvements for stormwater discharge—would be impractical and pointless because Río Nombre8875 constitutes the natural boundary that can be reached through a right-of-way easement (servidumbre de paso) in order to discharge the water by gravity.
Consequently, even the court-appointed expert himself is unsure which alternative would effectively allow the passage of the water, namely, the construction of improvements or a right-of-way easement crossing the property to be expropriated toward the channel of Río Torres. Unfortunately, the court-appointed expert disregards the review entrusted to him by this Court and transforms his assignment into mere forecasts rather than serious and detailed assessments, given that, in his view, any development undertaken on this land would have to provide for the treatment of its wastewater (aguas servidas), and therefore it would be necessary to extend the sanitary “outfall” pipe to a permanent watercourse, namely, the channel of Río Torres. In other words, from his perspective, it is necessary to establish a right-of-way easement across the property to be expropriated in order to drain the stormwater that AyA, it bears repeating, has never prevented from draining naturally to date.
Again, note the informal nature of the court-appointed expert’s statements when, in septiembre de 2015, he indicated that it was impossible to assess the cost of the works needed to drain the water because he did not know the characteristics of the possible project and, for that reason, also lacked data on the population served and the distribution of flows at the various points on the property. This is so not only because he had considered any effort aimed at determining the works that might eventually be required to drain the stormwater to be pointless, but also because he concluded that it was necessary to establish an easement for the discharge of that water from the parcel of land to be expropriated to the channel of Río Torres. In other words, the court-appointed expert bases his theory on mere presumptions, because he assumes that an easement for the passage of water (servidumbre de paso de aguas) must be established through the expropriated area, without any technical or scientific basis—a reckless and unfounded assertion contrary to the doctrine of sections 16.1 and 136 LGAP—since the alleged condition of being a hydraulically landlocked property (fundo hidráulicamente enclavado), which supposedly reduces the value of the affected remainder parcel retained by Asociación Pro Hospital de Niños practically to zero, is entirely untrue because AyA has not denied the passage of stormwater to date.
The court-appointed expert further considered that the amounts calculated in the administrative appraisal lacked any rational basis, even though, in the expert report addressing the original administrative appraisal (avalúo administrativo primigenio), he stated that the reasons why the administrative appraiser arrived at the assigned values were clear, sound, and derived from detailed work, even though AyA subsequently modified the total amount of compensation. Accordingly, it bears repeating that the expropriating entity’s failure to assess damage to the remainder was not a mere whim, but rather because, in this case, there is no damage whatsoever to the remainder of the land to be expropriated. Furthermore, on 23 de abril de 2019, the court-appointed expert issued an opinion regarding the new administrative appraisal and, with respect to damage to the remainder, again assumed that AyA was required to provide for the passage or discharge of stormwater and wastewater through the expropriated strip of land for the benefit of part of the remainder property, which now takes the form of a new parcel bearing Real Property Folio registration number 1-670386-000 (a property that, prior to the expropriation, formed part of the parent property F.R. 1-465031— 000).
This passage of water, which he argues should have been established as an easement to prevent the alleged damage to the remainder, should, in his view, have been registered on a North-South bearing toward Río Torres, to allow the drainage of stormwater and treated water (which might result from a future development of the remainder property). Here, it should be noted that the court-appointed expert appears to be unfamiliar with the applicable legal framework, since his position rests on mere presumptions and subjective assertions regarding future and uncertain events. The presiding judge is struck by the expert’s assertion that the remainder property has become hydraulically enclosed because it will be unable to drain its water freely without having to depend on the goodwill and judgment of AYA officials. Accordingly, based on the foregoing, the professional sets the quantum for damage to the remainder at ¢3.607.015.014,60 (Tres mil seiscientos siete millones quince mil catorce colones con 60/100); an amount that he claims to have set at 30% of the value stated in the administrative appraisal, that is, without any actual and objective technical basis.
This amount is manifestly disproportionate and unreasonable, contrary to the doctrine of sections 16.1 and 216 LGAP. The court-appointed expert fails to recognize that the proceedings at bar are in no way intended to generate an undeserved profit for either party to the legal-procedural relationship (relación jurídico procesal). Rather, it is the duty of the presiding judge to ensure a balance between the expropriating entity’s sovereign powers (potestades de imperio) and the rights and prerogatives afforded to the expropriated party (doctrine of art. 10 LGAP). In other words, no compensation may be awarded for damage to the remainder as a consequence of the partial expropriation at issue; moreover, any financial projection by the expropriated party concerning the remaining area of the land to be expropriated unquestionably amounts to mere speculation and is contrary to the proper interpretation of section 22 of the LE.
In other words, note that the judicial inspection (reconocimiento judicial) contained in the record shows that the stormwater discharge route from the adjoining and neighboring property converges there due to the topography of the affected property, which not only prevents the land from being subject to flooding but also means that the fact that the land is composed of stone, as asserted by the expropriated party, does not prevent such water from draining naturally, just as it did before the construction of the outfall-pipe works in el año 2015. Put more simply, AyA has never prevented the discharge of stormwater, whether channeled or not, or wastewater into Río Torres; for this reason, none of the compensation claimed by the expropriated Asociación is warranted here. The court-appointed expert, it bears repeating, relies on future and uncertain events, e.g., the alleged bad faith of AyA personnel, who, he assumes, will in the future prevent that water from discharging into the channel of Río Torres; however, it should be borne in mind that what does not exist on paper likewise does not exist in the factual or legal world.
Furthermore, contrary to the assertion of the expropriated party, it should be taken into account that it, and no one else, proceeded to break up the parent property even though it was aware of the notation of the expropriation order (mandamiento de expropiación) that this Court directed the Registro Público to record. To that extent, it must be clear that, in the private sphere, administered persons (personas administradas) may do anything that the law does not prohibit them from doing (doctrine of art.
28 of the Constitution), but this is not so when a legal person enters into a special relationship of subjection (relación de sujeción especial) (doctrine of art. 14.1 LGAP) and acquires the status of an expropriated party, as in the case at hand. This is because each and every one of its actions will have legal and material repercussions within the public sphere (doctrine of artículos 45 C.Pol., 11, 12, 13, 14 LGAP). Accordingly, the parcel segregation (segregación) carried out by the expropriated party on its property resulted in the preparation of a new administrative appraisal (avalúo administrativo), in which the amount of compensation increased considerably. In this regard, it should be noted that the expropriated party did not submit a single unsuitable (sic), relevant, and admissible item of evidence establishing that the remainder of the expropriated land was in fact rendered unusable or even constituted an unsuitable remainder (resto inadecuado) (doctrine of onus probandi, art. 317 de la Ley 7130 del 16 de agosto de 1989, applicable to the case at hand by continued application after repeal (ultraactividad)).
It bears particular emphasis that, during the course of these judicial proceedings, the expropriated party has not established that AyA caused any harm regarding the conveyance of stormwater from the adjoining and neighboring parcel to the Río Torres. Indeed, the channels constructed by the Asociación Pro Hospital de Niños remain operational today, and no act or omission by AyA establishing otherwise has been proven. The expropriated party has been unable to demonstrate that the expropriation of the parcel of land turns the remainder into an unsuitable remainder, much less into a “hydraulically” landlocked parcel (fundo enclavado), as the Nombre163406. erroneously found, because a landlocked parcel is simply one without frontage on a public road. Accordingly, in the case at hand, it has been established that the remainder of the expropriated party’s property will retain 266,98 linear meters of frontage.
Conversely, AyA will enter and exit the parcel of land to be expropriated through the adjacent and neighboring property along the western boundary, where the Planta de Tratamiento Los Tajos is located. In any event, AyA has not obstructed the runoff of conveyed water or wastewater from the property adjoining the parcel to be expropriated toward the Río Torres, because the only obstacle that could exist at present would be exclusively the topography of the land, since those waters currently flow normally through the channels constructed by the expropriated party itself; that is, the right to discharge stormwater from natural sources remains intact. In other words, no problems have arisen from the discharge of stormwater, as the expropriated party has baselessly maintained throughout these proceedings. Furthermore, regarding the remaining appraised items, it should be noted that the court-appointed expert (perito judicial) stated that he had no disagreement; in other words, as AyA understood it, the professional validated the amount of compensation established under both the original and subsequent administrative appraisals.
However, as the expropriating authority stated in its arguments seeking dismissal, the alleged damage to the remainder (daño al remanente) invoked by both the court-appointed expert and the expropriated party with respect to the property recorded in the Partido de San José under F.R. 670386-000, according to cadastral plan SJ-1824548-2015, pertains instead to another property registered by the expropriated party motu proprio and, as a matter of principle, bears no connection whatsoever to the registration of the easements (servidumbres) and expropriation assessed sub lítem by the expropriating authority, which were constituted prima facie over property F.R. Placa33339. This is because, from a registry standpoint, the property initially contemplated would not be affected, since once that segregation was carried out, the conditions of the affected property changed, e.g., its area, shape, regularity, and dimensions were reduced or altered; all of which would consequently affect the comparable-property valuation processes (procesos de homologación) and, of course, influence the unit value per square meter of the property subject to these judicial proceedings.
All of this made it imperative for the expropriating public entity to amend the administrative appraisal to account for the new characteristics of the property at issue. Accordingly, during the judicial inspection, this Court was able to verify in situ the existence of the stormwater outlets (desfogues pluviales) constructed by the expropriated Asociación, which had undergone no alteration as a consequence of the expropriation at issue, and the expropriated party has been unable to prove otherwise through useful, relevant, and probative evidence. Thus, it has been established that a stormwater outlet exists as of this date and that AyA has not denied the expropriated party’s property the right to discharge such waters. Likewise, as the expropriating authority categorically states, there is no obstructing element (wall or mound) preventing the stormwater from being discharged along its natural flow path to the site of the outfall pipeline works (tubo emisario), because the latter is aboveground in that sector (In this regard, compare the foregoing with photograph No. 1—Stormwater outlet—of the Official Letter submitted by AyA No. PRE-PAPS-2019-01658 del 13 de mayo de 2019).
Similarly, it should be noted that the stormwater discharge channel constructed by the expropriated party remains in perfect condition, as may be inferred from photographs 2 through 5 submitted by the expropriating authority with the aforementioned filing. In any event, as the expropriating Public Administration emphatically points out, pursuant to artículo 94 de la Ley de Aguas, Ley (No. 276) del 27 de agosto de 1942, should AyA in the future curtail or restrict the expropriated party’s ability to discharge stormwater, the latter is entitled, per se, to seek compensation for any damages and losses that such conduct may cause within its legal sphere. Likewise, the solution proposed by the Nombre163406.—namely, the construction of a right-of-way easement (servidumbre de paso) for discharging stormwater from the adjoining parcel across the remainder of the expropriated property toward the Río Torres—indeed lacks technical support, because, as the expropriating authority states in assertions that this Court plainly adopts as objective and consistent with the rules governing the unequivocal interpretation of science and technology: the hydrological conditions of the land could vary over time; the discharge of water resulting from development of the property in question might not be necessary because no such development exists; or the water to be discharged might contain dissolved harmful or foul-smelling substances and thus be incompatible with human health.
In short, the construction of the easement recommended by the court-appointed expert to purportedly mitigate the damage to the remainder caused by the expropriation of the parcel of land in question—damage that, in light of the foregoing, plainly does not exist—is unquestionably premature and lacks technical and legal support. Furthermore, another reason why we have departed from the expert opinion prepared by the Nombre163406. lies in the fact that he recommends compensation of slightly more than three billion colones to cover the cost of the works and equipment needed to discharge the water by pumping, even though he had previously stated that quantifying such costs was impossible. In other words, he casually recommends compensation of such an inherently substantial amount without any hydrological study of the contributing basin having been conducted; consequently, his assertions border not only on mere speculation and profound absurdity, but also draw attention to the lack of expertise and informality woven into the considerations set forth in his report.
All this is despite the fact that, once the works associated with the outfall pipeline were constructed, the expropriated party did not establish that any flooding had occurred on its property, nor was any flooding established by third parties neighboring the project, because property F.R. Placa33228 has stormwater outlets toward the Río Torres that remain intact as of this date, and there is likewise no obstructing physical element (walls, mounds, or others) preventing the passage of stormwater. Consequently, because the expert opinion prepared by the Nombre163406. lacked the degree, force, and legal weight necessary to overcome the financial offer contained in the administrative appraisal prepared by the Unidad Ejecutora del AyA and instead delved into mere speculation and made manifestly disproportionate compensation contingent upon future and uncertain events, contrary to the mandate issued by this Court concerning the objective and detailed review of the aforementioned instrument (doctrine of art. 35 LE). (…). For the time being, it is concluded that the administrative appraisal plainly complies with the legal regime applicable under artículo 22 LE; (…)”.
VIII.The first ground of appeal raised by the representative of the expropriated party focuses on the lower court’s analysis regarding the absence of damage to the remainder (daño al remanente) and the corresponding inapplicability of compensation, which he considers erroneous. Specifically, he asserted the following reasons: The crux of the matter, he explained, is that none of the administrative appraisals (avalúos administrativos) recognized this damage, and therefore no compensation was awarded for it, even though the existence of a channel conveying water to Río Torres, built by the Asociación before the present proceeding, was established, since such a channel is indispensable due to the impermeable nature of the land; he asserted that, as a result of the expropriation carried out, the property became hydraulically landlocked and that, from now on, they will continue to depend on the will of the expropriating authority to maintain the water outlet, and therefore the compensable damage is the loss of the right to convey the water freely to Río Torres.
For that reason, he stated, the rules of sound rational judgment (sana crítica racional) were violated because the report of Nombre163406. was not assessed in accordance with law, even though he was consistent and clear in his assessment of the damage caused to the remainder. This Chamber finds that the respected arguments of the representative of the expropriated party cannot be accepted, for the following reasons: First, the trial judge did not violate the rules of sound rational judgment in his decision because, from a reading of the substantive considerations, it can be concluded that he did jointly analyze the evidence received in the case, including the expert reports, the judicial inspection (reconocimiento judicial), and the documentary evidence contained in the case file, after which he concluded that no compensation whatsoever could be awarded in this particular case for damage to the remainder.
The court below explained in detail the reasons why it considered that the assessment performed by Engineer Peñaranda was not suitable for establishing the stated damage or rebutting the administrative appraisal; it thus found that the professional had made compensation for the remainder contingent upon a future and uncertain event and that, consequently, the alleged improvements for draining the water falling on the property were likewise contingent. It emphasized that the situation involving the outfall constructed in 2015 in no way prevents the drainage of water through the channels built by the current appellant before the present proceeding, which allow it to flow toward Río Torres; it stated that those channels remain operational today and that no act or omission by AyA establishing otherwise has been proven. It added that this was verified in situ by that Court during the judicial inspection and further based its finding on Official Letter No. PRE-PAPS-2019-01658 of May 13, 2019, submitted by AyA, and photographs 2 through 5, submitted by the expropriating party with the cited brief.
Regarding the investment that the professional stated the expropriated party might eventually have to make in costly and difficult-to-operate systems for disposing of such water, the judge highlighted the informal nature of that opinion, since the expert himself stated that it was impossible to quantify the cost of the works and equipment necessary to drain it through a “pumping” system until a detailed hydrological study of the contributing watershed was performed to establish runoff flow rates; he also characterized the report as contradictory because, separately and at the same time, it asserted that such a solution—improvements for draining stormwater (aguas pluviales)—would be impractical and pointless, because Río Nombre8875 constitutes the natural boundary that can be accessed through a right-of-way easement (servidumbre de paso) to discharge the water by gravity. The judge noted that the court-appointed expert based his theory on mere speculation, because he presumed that a water-conveyance easement (servidumbre de paso de aguas) had to be created across the expropriated area without any technical or scientific basis, which is contrary to the doctrine of provisions 16.1 and 136 LGAP.
With respect to the quantum of damage to the remainder, which the professional set at ¢3.607.015.014,60 (Tres mil seiscientos siete millones quince mil catorce colones con 60/100) and stated was based on 30% of the value assigned in the administrative appraisal, the lower court found that it lacked any genuine and objective technical basis; it also characterized the amount as disproportionate and unreasonable and as constituting a disproportionate windfall for the expropriated party, contrary to the provisions of section 22 of the Ley de Expropiaciones. It added that the appraisal performed by Nombre163406. recommended compensation of slightly more than three billion colones to cover the expenses for the works and equipment necessary to drain the water by pumping, despite having previously stated that it was impossible to quantify such expenses. After analyzing the expert opinion of Nombre163406. , the judge concluded that it lacked the force or legal soundness necessary to overcome the financial offer contained in the administrative appraisal because it was based on mere speculation and made plainly disproportionate compensation contingent upon future and uncertain events, contrary to the instructions issued by that Court regarding the objective and detailed review of the aforementioned instrument (doctrine of art. Placa33336 ).
As can be seen from the foregoing account, the Judge thoroughly stated the reasons supporting the denial of compensation for damage to the remainder and was clear in his reasoning and understanding of the position adopted by the court-appointed expert regarding the nature of the remaining property, which was characterized as “hydraulically landlocked,” a characterization that he did not endorse for the reasons stated, while also considering other evidence submitted to the case file.
IX.Furthermore, it is important to note that the grievance raised by the representative of the expropriated party cannot be accepted insofar as he claimed that “the lower court took advantage of the neglect of the third expert appointed to resolve the disagreement (perito tercero en discordia), which resulted in his assessments not being taken into consideration.” The fact is that the initial appointment of this expert was vacated by an order issued by the Trial Court at 08.42 hours on February 22, 2019, because Engineer Luis Amadeo Alvarado Boirivant failed to provide his technical opinion regarding the new administrative appraisal issued by the AyA Executing Unit. In that same decision, the parties were given an opportunity to state whether they required the appointment of another third expert to resolve the disagreement, an application that neither party made; nor did the current appellant express any disagreement with the ruling contained in the aforementioned order.
It was the failure of the interested parties, including the expropriated party, to make such a request that prevented the court from obtaining a technical opinion different from those already submitted, and the judge was therefore required to rule on the basis of the evidence contained in the case file. This does not reveal any improper attempt to take advantage of what occurred with respect to that evidence, much less any denial of the appellant’s right of defense. In another respect, the objection concerning the alleged lack of reasoning in administrative appraisal N°PREP-PAPS-2018-02246, dated June 11, 2018 and prepared by the AyA Executing Unit, likewise cannot be accepted. The appellant asserted that the Administration merely stated that the value of the damage to the remainder was zero; however, that assertion is inconsistent with the evidence contained in the case file. Although the body of the appraisal merely indicated that the before-and-after method (método del antes y el después) had been applied to determine the damage to the remainder, resulting in an assessment of zero colones, it also referred to Annex 8 of the worksheets for the explanation of the assessment performed.
A review of the case record shows that the following justification was provided in that annex, which was submitted together with the administrative appraisal: “According to the calculations performed, the property’s value per square meter increases after the segregation (segregación), primarily because the property acquires a more regular shape, since a ‘tail’ of the property that previously had a negative effect on its regularity is being eliminated, resulting in a change from a factor of 0.836 to 0.896. Another factor increasing the value per square meter is the area ratio because, as the property’s total area decreases, its ratio to the properties used for comparison tends to increase. Now, subtracting the values of the property Before and After, we obtain: ¢11 132 614 477, 06 - ¢12 023 383 382.00 = -¢890 768 905.16. The resulting value is negative, which indicates that no compensation should be paid for damage to the remainder because, upon segregation of the area identified in plan SJ-1631901-2013, the property acquires a more regular shape, thereby increasing the resulting value per square meter and, consequently, its total value.
(Annex 8, images 336-337 of the principal electronic case file). No grievance was raised regarding these technical matters that would permit analysis of the Administration’s justification for its assessment of the damage to the remainder using the before-and-after methodology. Furthermore, it must also be noted that there is no evidence establishing any loss or adverse effect on the Asociación’s current and actual activities or on the economic prospects of the remaining property. Indeed, during the oral hearing, the representative of the expropriated party acknowledged that the land is located in the western sector of Parque de Diversiones and had no particular use; he stated that it was a quarry area that the Parque had used to hold outdoor events. Under these circumstances, the Court does not perceive how the expropriation of the 12 135-square-meter parcel has the alleged adverse effect on the property’s economic prospects or its current use.
The conditions remain unchanged and its use has not been modified; therefore, in essence, there is no present damage eligible for compensation under the final clause of article 22 of the Ley de Expropiaciones, N°7495 and its amendments.
X.Damage to the Remainder Due to Its Becoming a Hydraulically Landlocked Property (fundo hidráulicamente enclavado): This Chamber essentially agrees with the opinion expressed by the a quo regarding the absence of damage to the remainder (daño al remanente) in the terms set forth by the court-appointed expert (perito judicial) Nombre163406. , insofar as he found it warranted on the basis of the concept of a “hydraulically landlocked property.” In this regard, it must be stated that compensable damage caused to a property—directly or indirectly—by the partial expropriation of the land or by the establishment of an easement (servidumbre) over it is recognized on the basis of the loss of desirability caused to the property that will remain under the ownership of the expropriated party, which has been termed “Damage to the Remainder.” This may result from multiple causes, most of them associated with the reduction or disappearance of factors that enhance the land’s value, for example: loss of frontage on a public road, irregularity of its shape, loss of panoramic views or scenic beauty, loss of water sources on land suited for agricultural or farming purposes, elimination of direct access to a public road, or limitations imposed upon the property arising from the establishment of easements with respect to the use and enjoyment of the property.
Compensation for these matters has been admitted in both administrative and judicial proceedings; in all cases, the damage must be real and permanent, and future events or mere expectations of rights may not be considered in determining it—article 22 in fine of Ley 7495 and its amendments. The foregoing constitutes an insurmountable limitation for both the Administration and the Judicial Bodies involved in determining just compensation (justo precio) pursuant to the cited statutory instrument. In this case, it is precisely this limitation that, from the outset, prevents recognition of the damage to the remainder claimed by the current appellant. It should be noted that it is an undisputed fact that the works giving rise to this expropriation proceeding, known as the “Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José,” were constructed in their entirety by the Instituto Costarricense de Acueductos y Alcantarillados, insofar as relevant here, along the western boundary of Parque de Diversiones, beginning in the year 2015.
The outfall pipelines (emisarios), which convey by gravity the water originating from four main collectors—Nombre280, Nombre8875, Nombre163407 and Nombre91549—to the Los Tajos treatment plant, were installed at elevation grades, as may be observed in the various photographs submitted to the case file, the judicial inspection conducted, and the different reports filed in the judicial proceedings; those works do not constitute an obstacle to the flow of water originating from the remainder property. Furthermore, it is also an undisputed fact that the stormwater discharge channels leading to Río Torres, constructed by the appellant Association prior to this expropriation, continue to serve the purpose for which they were created. Moreover, it was established that the expropriating authority installed on the expropriated land two culverts measuring 106 and 45 centimeters in diameter, respectively, which allow efficient discharge—report PRE-PAPS-2019-01658, images 162 and photographs 163 and 164 of the main electronic case file—so much so that, to date, no claim whatsoever has been made concerning flooding problems on the land.
This information, which appears in the record and which, it bears repeating, comprises undisputed facts, demonstrates that the remainder property’s stormwater discharge conditions toward Río Torres remain unchanged, with the evidentiary advantage that the works in the area under discussion were completed approximately seven years ago, thereby providing a clear understanding of their structures and dimensions, which are compatible with the existing channels. The report of the court-appointed expert, Eng. Peñaranda, proceeds from a circumstance that cannot be assessed from a legal standpoint: namely, deriving damage to the remainder from a future and uncertain event, consisting of the inability to discharge water toward Río Torres. He even refers to the potential need to resort to pumping-based discharge mechanisms, which he himself acknowledges he cannot quantify in terms of economic cost and practicality because more extensive hydrological studies are required.
He stated verbatim: “(…)That it is impossible to quantify the estimated value of the works and equipment required to evacuate the water by ‘pumping’ until a detailed hydrological study of the drainage basin (cuenca tributaria) is conducted to determine runoff flows (caudales de escorrentía). Furthermore, this solution is plainly impractical and senseless given that Río Nombre8875 is a natural boundary that may be accessed through a right-of-way easement (servidumbre de paso) in order to discharge the water by gravity (…)”—expert report dated 23 de abril del 2019, image 180 of the main electronic case file. As the lower-court judge observed in his ruling, the report’s ambiguity and lack of definitiveness inevitably diminish its credibility. It also proceeds from a presumption of bad faith on the part of the Administration—namely, that it would change its current conduct of open and genuine cooperation with water discharge, which is also compatible with the works performed, and adopt a restrictive position in that regard.
It should be observed that, as a general principle of law, good faith is always presumed, whereas bad faith must necessarily be proven. In this case, the conduct of the expropriating entity, analyzed under the principle of legitimate expectations (principio de confianza legítima)—article 137 of Ley General de la Administración Pública—demonstrates that the conduct of the expropriating Administration is aimed at maintaining the stormwater discharge conditions existing at the time of the expropriation and, as noted above, even improving them. Far from showing otherwise, this Chamber finds no evidence from which future conduct to the contrary may be inferred. Consistent with the foregoing, there is no legal basis for imposing an easement to discharge the water, as stated by Nombre163406. , because under current conditions the water continues to flow without difficulty through the infrastructure constructed for that purpose.
During the oral appellate hearing, the representative of the expropriated Association asserted that the damage claimed consists of the loss of the right to continue conveying the water, which the Court understands to mean freely, without having to depend on the will of the Administration. However, that too constitutes a future and uncertain event because, consistent with the foregoing, the Administration has to date left the conveyance of water through the preexisting channels unchanged. Should the land conditions eventually change, or should it become necessary to intervene in the channels or culverts, the mechanisms provided by the legal system must be used to address those potential circumstances. Finally, this Chamber cannot overlook the fact that the amount determined by Nombre163406. as damage to the remainder is entirely devoid of technical support. It should be noted that a 30% reduction in the property’s value was established without explaining the technical basis for that percentage, resulting in compensation exceeding three billion colones.
The professional merely stated: “(…)I estimate the damage to the remainder at 30% of the value assigned by the document prepared by Eng. Koying Ng, because its reconciliation in the before-and-after valuation exercise does not account, among its comparable properties, for the fact that the appraised property lacks the freedom to discharge its water and that its market value is therefore far lower than that of the comparable properties that do enjoy such a condition. Accordingly, it is my opinion that APHNN must be compensated in the amount of colones 12.023.383.382x0,3= colones 3.607.015.014.60 (three billion six hundred seven million fifteen thousand fourteen colones and sixty céntimos), since there is otherwise no way to determine the cost of constructing the infrastructure works required for water evacuation and their operating cost over time (…)”. (expert report dated 23 de abril del 2019, image 181 of the main electronic case file).
The amount thus determined is also ambiguous and even contradictory because, on the one hand, it is stated to represent the property’s loss of desirability due to its lack of freedom to discharge its water, while, on the other hand, it is concluded that there is no other way to determine the cost of constructing the infrastructure works. This lack of definition and supporting rationale constitutes an additional obstacle to accepting the valuation performed by Nombre163406. . This Chamber agrees with the opinion expressed by the lower-court judge: the foregoing is contrary to the rules of science and technical practice, which, pursuant to article 16 of Ley General de la Administración Pública, must support the work of the Administration, the judicial bodies, and court-appointed experts as well, who in the performance of their duties serve as officers of the administration of justice, in this case for the purpose of determining just compensation.
XI.Conclusion: In view of the foregoing, the appeal filed by the representative of the expropriated party must be denied in its entirety, since his respectable arguments lack sufficient force to overturn the decision rendered, which must be affirmed.-
POR TANTO:
With respect to the matters appealed, and for the reasons stated, the judgment issued by Judge Billy Araya Olmos, N°1279-2021-E at 14:03 hours on 24 de junio de dos mil veintiuno, clarified by the ruling issued at 10:58 hours on 21 de setiembre del 2021, is affirmed. ANEXO A. Goicoechea, a las ocho horas quince minutos del dieciocho de febrero de dos mil veintidós.- Diligencias judiciales de fijación del justiprecio en expropiación, promovidas por el Instituto Costarricense de Acueductos y Alcantarillados (AYA), en la persona de su apoderada especial judicial Ana Victoria Sánchez Villalobos, contra la Asociación Pro Hospital Nacional de Niños, representada por su Presidente, Nombre162464 , cédula número CED126629. También es parte, el Instituto Costarricense de Electricidad.- Como apoderado especial judicial de la expropiada, figura el licenciado Luis E. Sibaja Guillén. Por apelación de la parte expropiada, conoce este Tribunal de la sentencia de primera instancia, N°1279-2021-E de las 14:03 horas del 24 de junio de dos mil veintiuno, aclarada mediante resolución de las 10:58 horas del 21 de setiembre del 2021. Se resuelve, previa audiencia a las partes y por unanimidad.- Redacta la Jueza Aragón Cambronero, y
CONSIDERANDO:
I).- CUESTIONES DE TRÁMITE: El Instituto Costarricense de Acueductos y Alcantarillados, promueve estas diligencias, para que se establezca el precio que debe pagar a la Asociación Pro Hospital Nacional de Niños, por la constitución de dos derechos de servidumbre de alcantarillado sanitario y de paso sobre dos franjas de terreno de 8.551,00 y 107,00 metros cuadrados, así como por la segregación de un lote que posee un área de 12.135,00 metros cuadrados de un inmueble de su propiedad, el cual se ubica en La Uruca, está inscrito en el Registro Público bajo el folio real matrícula Placa33226 del Partido de San José, posee el plano catastrado Placa33227, con un área total de 336.945,99 metros cuadrados. Para construir un Emisario que es parte integral del Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José, el AyA necesita expropiar parcialmente este terreno y constituir los derechos de servidumbre antes consignados. La expropiada, se opuso al avalúo administrativo. Luego del trámite de rigor, el Juez, Billy Araya Olmos, en sentencia N°1279-2021-E de las 14:03 horas del 24 de junio de 2021, dispuso:
"POR TANTO: En mérito de lo expuesto, y con base en las consideraciones de hecho y derecho que preceden, en lo no expresamente concedido entiéndase denegado; SE CONFIRMA la oferta económica contenida en el Avalúo administrativo elaborado por la Unidad Ejecutora del AyA N° PREP-PAPS-2018-02246 del 11 de junio de 2018 , que asciende al monto de ¢362.266.058,oo (TRESCIENTOS SESENTA Y DOS MILLONES DOSCIENTOS SESENTA Y SEIS MIL CINCUENTA Y OCHO COLONES). Indemnización que comprende los siguientes rubros, a saber:
Lo resuelto fue corregido mediante auto de las 10:58 horas del 21 de setiembre del 2021, en el cual se dispuso:
“(…) De conformidad con el artículo 220 del Código Procesal Contencioso Administrativo y el artículo 63 del Código Procesal Civil, se corrigen los errores materiales que contiene la resolución de las catorce horas y tres minutos del veinticuatro de junio de dos mil veintiuno, para que: a. en el punto "SEGUNDO.- HECHOS PROBADOS" en el numeral 8°-) al desglosar el valor de las servidumbres 1 y 2 y el terreno a expropiar, en el acápite "2) El valor de la servidumbre 2" al referirse al valor del daño al remantente (sic); b. en el punto SEXTO.- CONFIRMACIÓN DE LA OFERTA ECONÓMICA (página 33 de la sentencia) y c. al final en su parte dispositiva, en lugar de "¢104.993.000,00 (ciento cuatro millones novecientos noventa y tres mil colones)", se lea correctamente: "¢104,993.00 (ciento cuatro mil novecientos noventa y tres colones)". (imagen 32 del legajo de alzada).
Inconforme con dicho fallo, apeló en tiempo y forma el apoderado de la parte expropiada, recurso admitido y en virtud de lo cual, se entra a su análisis de seguido.- II).- HECHOS PROBADOS: Se avalan los así consignados en la sentencia recurrida, por ser contestes con los elementos de convicción que se citan en su apoyo. No obstante, se adiciona el hecho número 8, en su apartado 3), en el siguiente sentido: En el cálculo del daño al remanente se utilizó la metodología del Antes y Después, señaló:“ los cuales se pueden observar en los anexos de Cálculos”, fijando el valor por este concepto en cero colones. (Idéntico sustento probatorio al indicado en la resolución recurrida). Se agregan los siguientes hechos probados: 15).- Que en el Anexo 8 del avalúo administrativo, elaborado por la Unidad Ejecutora del AyA, N°PREP-PAPS-2018-02246 del 11 de junio de 2018, correspondiente a las hojas de cálculo, se indicó lo siguiente: “ De acuerdo con los cálculos realizados el valor por metro cuadrado de la propiedad aumenta después de la segregación, debido principalmente a la mejor regularidad que adquiere la propiedad, ya que se está eliminando una “colita” de la finca, la cual antes influía negativamente en la regularidad, pasando de un factor 0.836 a 0.896.
Otro factor que aumenta el valor por metro cuadrado es el de la relación de áreas, ya que la cantidad de área de la finca disminuye, por lo que la relación con las propiedades a homologar tiende a aumentar. Ahora bien, realizando la diferencia entre los valores de la finca Antes y Después, obtenemos: ¢11 132 614 477, 06 - ¢12 023 383 382.00 = -¢890 768 905.16. El valor resulta negativo, lo que indica que no se debe pagar daño al remanente, pues la finca al segregar el área indicada en el plano SJ-1631901-2013 obtiene una forma más regular, lo que ayuda a aumentar el valor por metro cuadrado resultante y por consiguiente un valor total mayor. (Anexo 8 imágenes 336-337 del expediente electrónico principal). 16) El expropiante instaló, en el terreno expropiado, dos alcantarillas con diámetros de 106 y 45 centímetros respectivamente, que permiten el desfogue de las aguas provenientes del área remanente.
(Así informe PRE-PAPS-2019-01658 y fotografías a imágenes 162, 163 y 164 del expediente electrónico principal)- III).- HECHOS NO PROBADOS: Se avala el elenco de hechos tenidos por no acreditados, por cuanto son reflejo de la realidad probatoria que consta en el expediente; se agrega como hecho indemostrado, el siguiente: 3)- Que la segregación del lote de 12135 metros cuadrados, descrito en el plano de catastro SJ-1631901-2013, provoque una afectación a la actividad actual y real de la Asociación y a la proyección económica del bien, que incluye el área del remanente. (Los autos son omisos al respecto).
IV).- RECURSO DE LA EXPROPIADA. Manifiesta el apoderado de la Asociación expropiada en su memorial de fecha 20 de setiembre del 2021, en síntesis, el análisis realizado por el a quo en cuanto a la no existencia del daño al remanente y su correlativa improcedencia, es erróneo. Alega, ninguno de los avalúos administrativos, indicó la existencia de este daño del lote o terreno expropiado. Dice, la expropiación de las servidumbres 1 y 2, no son parte de este recurso, por lo que sus reproches no se extienden a estas, sólo en cuanto a la expropiación del terreno de 12135 metros cuadrados, conforme al plano de catastro SJ-1631901-2013, que se encuentra entre el Río Nombre8875 y el remanente; afirma, en el año 2009 se construyó un canal de piedra, con el fin de que el agua no quedara atrapada en el terreno, como antes sucedía, este conduce las aguas al Río Torres, en medio se encuentra la propiedad que está siendo ahora expropiada, advierte, una vez que el bien quede a nombre del AyA, no tiene obligación de recibir las aguas, de allí el daño al remanente.
Afirma, la franja de terreno expropiado servía como vía de desfogue de aguas pluviales conducidas hacia el Río Torres, provenientes del fundo vecino y colindante,(terreno impermeable por estar compuesto principalmente de piedra), con la expropiación, se torna imposible mantener esa conducción, por lo que el remanente se convierte en un fundo enclavado hidráulicamente, siendo que las aguas deberán expulsarse de otra forma, esto se puso de manifiesto, dice, con el peritaje del Ing. Fernando Peñaranda, en sus diferentes informes. Asegura, se ha afectado la proyección económica del bien respecto del remanente. Increpa, se debe responder por los menoscabos provocados, como propietaria de la finca 1-465031-000, el fundo segregado es el N° 1-670386-000. Insiste, el informe del Nombre163406. , analiza el problema pluvial y de aguas en el terreno remanente, mientras que los avalúos administrativos no lo hicieron, acusa la violación a los artículos 22.1 de la Ley de Expropiaciones y 3 de la Ley 6313.
Argumenta, en los informes del 2013, 2015 y 2019, el Nombre163406. , es consistente en afirmar la existencia del daño al remanente, el juez omitió realizar un análisis justo y razonable de estas pericias, causándole indefensión, acusa violación a las reglas de la sana crítica, en la apreciación de la prueba técnica y el reconocimiento judicial. Durante la celebración de la audiencia oral de apelación, celebrada el 05 de noviembre del 2021, expuso su inconformidad en el análisis realizado por el a quo, sobre la no existencia del daño al remanente, el cual calificó de erróneo, adujo, en ninguno de los avalúos administrativos se reconoció este daño por lo que no se les compensó, este es el meollo del asunto, tanto así, resalta, que el juzgador de instancia, en auto de las 14:15 horas del 16 de mayo del 2018, ordenó la corrección al avalúo administrativo inicial, previniendo se explicara: ¿Porqué, no procedía el daño al remanente?
No obstante, asegura, esto no se cumplió, pues en el avalúo del 11 de junio del 2018, simplemente se limitó la Administración a decir que el valor era igual a cero. Insiste, se trata de un fundo impermeable que requiere del desfogue, con la expropiación es imposible conducir las aguas al Río Torres, lo que lo convierte en un fundo enclavado hidráulicamente, resalta, las aguas deberán ser vertidas en forma diferente a la actual, nada de esto se señaló en los avalúos administrativos, como sí lo explicó el Ing. Fernando Peñaranda, en sus informes, en especial en el final de fecha 04 de abril de 2019, donde expresamente reconoció la existencia del daño al remanente, provocado principalmente por el desfogue de aguas, sin tener que depender de la buena fe del expropiado, lo cual ya lo había manifestado en oficio del 12 de setiembre del 2013. Dice, existe una afectación a la actividad actual y real de la Asociación y a la proyección económica del bien, que incluye el área del remanente y la expropiada.
Estima erróneo el razonamiento contenido en la sentencia recurrida, acerca de la falta de prueba sobre el impedimento para desfogar las aguas por el fundo del A y A, dice, la existencia del canal construido es anterior al proceso expropiatorio, el expropiante ha señalado que las condiciones del bien no han variado, y para ello aportó fotografías, dejando de manifiesto que no existe una barrera que impida el desfogue pluvial, esto se expuso en el oficio PAPS-2019-01658 del 13 de mayo del 2019; la postura allí indicada fue avalada por el a quo en la sentencia recurrida, para rechazar la indemnización del daño al remanente, el cual incluso citó. Agravia, se equivoca el juzgador, toda vez que el problema radica en la pérdida del derecho de poder conducir las aguas al Río Torres, lo cual es indemnizable, y se podría ver afectada a futuro, cuando se cierre este expediente, puesto que una vez propietaria del inmueble, la Administración podría impedir la conducción de aguas.
Argumenta, a partir del acuerdo de la Junta Directiva del AYA, número 2013-231 del 28 de mayo de 2013, la posibilidad real, para su representada, de conducir las aguas por el canal se perdió, aquí es donde se genera la incertidumbre y nace el derecho a la indemnización. Resalta, en el oficio PAPS-2019-01658, relacionado, se establece que la posibilidad de permitir el desfogue de las aguas, dependerá de la autorización del propietario del fundo en cuestión. Increpa, acá solo se podría evitar el daño, con la imposición de una servidumbre -como se pidió inicialmente- o bien la indemnización por el daño al remanente, todo lo cual fue valorado por el perito judicial Nombre163406. . Advierte, el a quo omitió realizar un análisis justo y razonable de los avalúos del perito judicial, no aplicó las reglas de la sana crítica, ni apreció la prueba en su conjunto, dejando de lado la valoración del citado experto, invoca los artículos 22.1 y 03 de la Ley de Expropiaciones.
Acusa, se ha causado indefensión al expropiado, al dejar de analizar los reportes del perito judicial, rechazándose la compensación a que tiene derecho por el daño al remanente, omitió el juez analizar, que la conducción de las aguas se realiza a través del canal construido en el año 2009 para ese fin; resalta, el a quo se aprovechó de la desidia del perito tercero en discordia, que llevó a que sus valoraciones no se tomaran en consideración, por lo que estima resulta necesario un dictamen de un tercero en discordia, que en esta instancia ofrece como prueba para mejor resolver o bien un peritaje de parte. Pide, se revoque la resolución recurrida y se fije el daño al remanente en los términos expuestos por el Nombre163406. . Sobre el uso del terreno al momento de la expropiación, aclaró que no tenía un uso particular, dijo, es una zona de tajo, que se ha utilizado por el Parque de Diversiones, para realizar eventos al aire libre; el terreno se encuentra en el sector Oeste del Parque.
Adicionó, el daño indemnizable es la pérdida de derecho para conducir las aguas que el fundo recibe, la Institución expropiante hasta la fecha ha permitido su conducción, pero a futuro este se pierde, se trata de un daño real y actual, por no tener el acceso al Río Torres. La disminución que tiene el propietario del bien es esa pérdida de derecho de continuar conduciendo las aguas.
V).- ALEGATOS DE LA ENTIDAD EXPROPIANTE. La representación del Instituto, por su parte, alegó, la sentencia apelada se conforma a derecho. Se refirió a la naturaleza de un fundo enclavado, que de acuerdo con los numerales 395 y siguientes del Código Civil, obligan a constituir un derecho de servidumbre. Advierte, lo que la parte alega, es la existencia de un fundo hidráulicamente enclavado, lo cual no encontró dentro de la literatura al respecto, sin embargo, sí ubicó la denominada servidumbre natural, regulada en el artículo 94 de la Ley de Aguas. Resalta, no se puede a priori establecer una servidumbre sobre un bien demanial, a favor de un particular. Manifiesta, Nombre5630 , ha aceptado la conducción de aguas a través de los canales existentes, tanto para el terreno expropiado como para el remanente; incluso, resalta, ha mejorado los canales y desfogues, de hecho cuando se construyó el emisario -tubería aérea sobre grandes bases de concreto- se creó una alcantarilla fluvial enorme que va debajo del emisario para poder conducir fácilmente las aguas, esto consta en el expediente judicial, en fotografías donde está claramente visible la situación constructiva del emisario; analizó, la obligación de disponer de las aguas fluviales, reside en el propietario del fundo que las recibe, así lo disponen los artículos 04 y 94 de la Ley de Aguas y 285 de la Ley General de Salud; no existe un derecho para conducir las aguas, una vez que la propiedad pase a manos del A y A, por lo que se deberá contar con el criterio de la Contraloría General de la República, para imponer cualquier gravamen; invoca en su apoyo, el criterio de la Procuraduría General de la República C-154-2003 del 02 de junio del 2003, donde se analiza un supuesto semejante al alegado.
Dice, el emisario tiene 05 años de construido y no se ha presentado ningún problema con la conducción de aguas. En cuanto al peritaje judicial, insiste, se debe referir a la revisión del avalúo administrativo conforme al artículo 22 de la Ley de Expropiaciones, sin contemplar daños futuros o inciertos, en este caso el perito judicial parte de suposiciones, meras especulaciones. Dice, el principal interesado en que las aguas se desfoguen adecuadamente es el A y A, quien tiene normas especiales al respecto. En este caso, aplicada la metodología de valoración del antes y el después, el lote remanente más bien aumentó su valor, porque al quitarse la franja ubicada a la orilla del río, desaparecieron las desventajas que conlleva. Dice, no aplica tampoco el artículo 17 de la Ley de Expropiaciones. Afirma, el segundo avalúo administrativo, elevó el monto del remanente porque era un lote más pequeño, con la segregación se le dio más regularidad, este resto de finca no sufre daño alguno; en cuanto a la impermeabilidad del suelo no es una consecuencia de la expropiación, se trata de una condición propia del terreno.
Insiste, su representada no ha afectado la conducción de aguas, en el futuro si ello ocurriere deberá acudirse a las vías procesales previstas por el Ordenamiento Jurídico. Se opuso a la prueba técnica ofrecida para mejor resolver. Solicitó como prueba para mejor resolver, se realice un reconocimiento judicial.
VI).- SOBRE LA PRUEBA PARA MEJOR RESOLVER: En el presente caso, ambas partes ofrecieron durante la celebración de la audiencia oral celebrada el pasado 05 de noviembre del 2021, prueba para mejor resolver, consistente en el caso del apelante, en el nombramiento de un perito tercero en discordia, o bien un peritaje privado; en tanto la representación del ente expropiante, pidió se realizara un reconocimiento judicial en el fundo objeto de la presente expropiación. Se deja constancia, que ambas probanzas se rechazaron de forma oral durante el desarrollo de la audiencia de apelación, conforme consta en el audio gravado de la misma, incorporado al expediente electrónico, carpeta de apelación.
VII).- SOBRE EL FONDO DEL RECURSO: A efecto de delimitar la competencia de esta Cámara en el conocimiento del recurso de apelación formulado por el representante de la parte expropiada, resulta indispensable señalar, los reproches se dirigieron en concreto a lo resuelto por el Juzgador de Instancia, en lo relativo al rechazo de indemnización por el daño al remanente, que según reclama el hoy recurrente, ocurre con motivo de la segregación de la franja de terreno de 12 135 metros cuadrados, descritos en el plano catastrado SJ-1631901-2013, lo que se alega, convierte el resto de la finca propiedad de la Asociación, en un fundo hidráulicamente enclavado, de manera que pretende sea indemnizado; en cuanto a los demás aspectos contenidos en la sentencia impugnada, mostró expresamente su conformidad. Así las cosas, es indispensable rescatar lo considerado por el a quo, sobre el particular estimó, en lo que resulta de interés:
SEXTO.- CONFIRMACIÓN DE LA OFERTA ECONÓMICA. Prima facie, es de entidad mencionar que este Despacho Judicial, merced de la resolución de las 08.42 horas del 22 de febrero de 2019, dejó sin efecto el nombramiento del tercer perito judicial Ing. Luis Amadeo Alvarado Boirivant, quien omitió verter su criterio técnico respecto del nuevo avalúo administrativo, emanado de la Unidad Ejecutora del AyA. Paralelamente, se confirió audiencia a las partes para que manifestasen si requerían o no el nombramiento de otro perito en discordia; gestión que ninguna de las partes fue en formular ante estos Estrados Judiciales. - Por lo pronto, el tema medular para la determinación de la indemnización en autos, obedece, sucintamente, al supuesto daño al remanente, habida cuenta de la expropiación parcial de la finca madre F.R. 1-465031-000, lote de terreno que mide 12.135,00 m², conforme al plano de catastro SJ-1631901-2013.
Sin embargo, nunca acreditó la persona jurídica expropiada de que, el AyA hubiese negado el derecho de evacuación de las aguas pluviales de la finca propiedad de la Asociación Pro Hospital de Niños, F.R. Placa33228, que nace a consecuencia de un acto jurídico realizado motu proprio, por parte de la expropiada, durante el trámite de estas diligencias ante este Despacho. En otras palabras, el ente público expropiante no ha negado en ningún momento el desagüe de las aguas provenientes de fuentes naturales, menos aún, ha impedido que el agua pluvial transcurra libremente por donde naturalmente deba fluir al arribar al sitio donde se encuentran las obras del tubo Emisario; ello, por cuanto dicha tubería es aérea, y en lo absoluto restringe el libre paso del agua de lluvia. Sin duda alguna, el diferendo en el sub lítem, recae en este punto medular, toda vez que los valores asignados por el AyA, tanto para los derechos reales de servidumbre, cuanto para sus respectivos daños al remanente, fueron avalados por el Nombre163406. , cuya pericia, se insiste, es la única que rola en autos, por cuanto se revocó el nombramiento del tercer perito en discordia -según se anticipó- debido a que omitió verter el criterio técnico requerido por el juzgador de turno, en tratándose del nuevo avalúo administrativo.
Así las cosas, el Nombre163406. , manifestó que el AyA no introdujo el derecho de una vía de salida de las aguas de lluvia, por gravedad, que discurren por el predio. Adicionalmente, denunció que el expropiante omitió valorar el costo que en el futuro tendrían las medidas de evacuación de estas aguas en caso de que sea necesario eliminarlas por medios artificiales (tanques de almacenamiento y sistemas de bombeo). En ese contexto, no lleva razón el profesional, por cuanto condiciona la indemnización que presupone amerita el daño al remanente a consecuencia de la expropiación, a un hecho futuro e incierto, esto es, las supuestas mejoras para evacuar el agua que cae en la finca, la cual, ni siquiera forma parte del objeto de las diligencias sub júdice, la finca F.R. 1-670386-000, segregada de la finca madre a expropiar (F.R. 1-465031-000). En otras palabras, el señor perito judicial ni por asomo se ocupa verdaderamente en cuantificar los daños reales y permanentes, como lo pregonan los numerales 2, p. 2° y 3 de la Ley 6313 del 04 de enero de 1979, en concordancia con el artículo 22 in fine de la Ley de Expropiaciones, Ley (No. 7495) de 3 de mayo de 1995, publicada en el Alcance No. 20 a La Gaceta No. 110 de 8 de junio de 1995.
Tampoco le asiste la razón ni a él, ni a la parte expropiada, cuando aducen que, el AyA no garantiza el derecho de paso de las aguas de lluvia, a saber, escorrentía natural o producto del desarrollo del terreno; tampoco al especular que, se estaría creando un "fundo pluvialmente enclavado", ante la supuesta imposibilidad de evacuar sus aguas de forma natural. Tampoco es dable el afirmar que persona la (sic) expropiada deberá invertir, eventualmente, en sistemas onerosos y de difícil operación para la disposición de dichas aguas. Nótese además lo informal del criterio externado por el perito judicial, quien supone que, era imposible cuantificar el valor de las obras y equipos necesarios para la evacuación de las aguas por "bombeo", hasta tanto no se realice el estudio hidrológico detallado de la cuenca tributaria para establecer los caudales de escorrentía. A todas luces, resultan harto contradictorias sus manifestaciones, en tanto que, paralelamente, afirmó que dicha solución -mejoras para el desfogue de las aguas pluviales- sería impráctica y carente de sentido, debido a que el Río Nombre8875 figura como el límite natural al cual se puede acceder a través de una servidumbre de paso para descargar las aguas por gravedad.
En consecuencia, ni el propio perito judicial está seguro de qué alternativa es la eficaz para permitir el paso de las aguas, a saber, construcción de mejoras, o una servidumbre de paso que atraviese el predio a expropiar hacia el cauce del Río Torres. Desafortunadamente, el señor perito judicial, hace caso omiso a la revisión encomendada por este Despacho, y muda su encargo en meros pronósticos no así valoraciones serias y detalladas, dado que, en su concepto, cualquier desarrollo que se lleve a cabo en este terreno deberá contemplar el tratamiento de sus aguas servidas y por lo tanto existiría la necesidad de llevar el tubo "emisario" sanitario, hasta una vía de agua permanente, esto es, el cauce del Río Torres. En otras palabras, desde su óptica, resulta de entidad constituir una servidumbre de paso a través de la propiedad a expropiar, para evacuar las aguas pluviales que el AyA, se insiste, a la fecha, nunca ha impedido se evacúen naturalmente.
Nuevamente, nótese lo informal de las manifestaciones del perito judicial cuando en septiembre de 2015, señaló que era imposible valorar el costo de las obras necesarias para la evacuación de las aguas porque desconoce las características del posible proyecto, en razón de lo cual tampoco tiene el dato de la población servida ni la distribución de los caudales en los diferentes puntos del inmueble. Ello, no sólo porque había estimado inocuo cualquier ejercicio encaminado a determinar los eventuales trabajos a realizar para evacuar las aguas pluviales, sino, además, porque concluyó de que era menester construir una servidumbre para el desfogue de dichas aguas desde el lote de terreno a expropiar hasta el cauce del Río Torres. En otras palabras, el perito judicial matricula su tesis en meras presunciones, porque presume se debe constituir una servidumbre de paso de aguas por la zona expropiada, sin ninguna base técnica ni científica -afirmación temeraria e infundada, contraria a la doctrina del canon 16.1 y 136 LGAP-, toda vez que que la supuesta condición de fundo hidráulicamente enclavado que reduce el valor de la parcela afectada remanente en poder de la Asociación Pro Hospital de Niños prácticamente a cero, carece de toda veracidad porque el AyA, no ha negado el paso de las aguas pluviales, a la fecha.
Ahora bien, el perito judicial consideró que los montos calculados dentro del avalúo administrativo, adolecen por falta de sentido pese a que en el informe pericial en el que se refirió en torno al avalúo administrativo primigenio, indicó que las razones por la cuales el valuador administrativo arribó a los valores asignados, eran claros, serios y obedecían a un trabajo detallado, esto es, aún y cuando, posteriormente, el AyA, modificó el monto total de la indemnización. Así las cosas, se insiste, el hecho de que el expropiante no haya valorado el daño al remanente no es una mera ocurrencia, sino, porque, en la especie, no hay ningún daño al remanente del terreno a expropiar. De otra parte, el 23 de abril de 2019, el perito judicial se pronunció respecto del nuevo avalúo administrativo, y en relación con el daño al remanente, supuso, nuevamente, que el AyA debía contemplar el paso o desfogue de aguas pluviales y aguas servidas a través de la franja de terreno expropiada y en beneficio de parte del predio remanente, que ahora tiene la forma de una nueva parcela con número de matrícula de Folio Real 1-670386-000 (fundo que previo a la expropiación, formaba parte de la finca madre F.R. 1-465031— 000).
Este paso de aguas, que justifica debió haberse llevado a cabo como una servidumbre para evitar el supuesto daño al remanente, debió registrarse, en su concepto, con rumbo Norte - Sur con dirección hacia el Río Torres, para permitir desaguar las aguas pluviales y tratadas (que pudieran provenir de un futuro desarrollo del predio remanente). Aquí, considérese como el perito judicial, parece desconocer el régimen jurídico aplicable, dado que hace descansar su postura en meras presunciones y aseveraciones subjetivas, respecto de hechos futuros e inciertos. Llama la atención de quien por turno juzga, que el perito afirme que, el predio remanente ha quedado encerrado hidráulicamente, porque no podrá evacuar sus aguas libremente, sin tener que depender dé la buena voluntad y el criterio de los funcionarios de AYA. Así las cosas, a raíz de lo expuesto, el profesional fija un quantum por concepto del daño al remanente en la suma de ¢3.607.015.014,60 (Tres mil seiscientos siete millones quince mil catorce colones con 60/100); monto que supone fija con base en el 30% del valor dado en el avalúo administrativo, es decir, sin ningún sustento técnico real y objetivo.
Monto que erige harto desproporcionado e irrazonable, contrario a la doctrina del canon 16.1 y 216 del LGAP. Desconoce el señor perito judicial que las diligencias sub lítem en lo absoluto tienen por finalidad generar un lucro inmerecido a una u otra parte dentro de la relación jurídico procesal. Antes bien, es tarea del juez a cargo garantizar el equilibrio entre las potestades de imperio del expropiante, frente a los derechos y prerrogativas que le asisten a la persona expropiada (doctrina del art. 10 LGAP). En otras palabras, no es dable compensar ninguna indemnización por concepto del daño al remanente, a consecuencia de la expropiación parcial en autos; e, incluso, cualquier proyección económica de la parte expropiada sobre el resto de la cabida del terreno a expropiar, cae, sin lugar a dudas, en meras especulaciones, y resulta contrario a la inteligencia del numeral 22 de la LE. En otras palabras, nótese que de acuerdo al reconocimiento judicial que obra en autos, se colige que la vía de desfogue de aguas pluviales provenientes del fundo anexo y colindante, confluyen merced de la topografía de la finca afectada, lo cual no sólo impide que el terreno sea objeto de alguna inundación, sino, además, que el hecho de que el terreno esté compuesto de piedra, tal y como lo aduce la parte expropiada, no es óbice para que dichas aguas desfoguen naturalmente, tal y como sucedía antes a la construcción de las obras del tubo emisario en el año 2015.
Más sencillo, el AyA en ningún momento ha impedido la evacuación de las aguas, pluviales conducidas o no y servidas, en el Río Torres; razón, ésta, por la cual no cabe aquí ninguna indemnización como la reclamada por la Asociación expropiada. El señor perito judicial parte, se insiste, de hechos futuros e inciertos, v. gr. la supuesta mala fe de los colaboradores del AyA, quienes, presupone, le impedirán a futuro el desfogue de dichas aguas hacia el cauce del Río Torres, sin embargo, considérese que aquello inexistente en el papel resulta también redunda como inexistente en el mundo fáctico y jurídico, inclusive. Ahora bien, contrario a lo que afirma la parte expropiada, tómese en consideración que fue esta y no otra, quien procedió a desmantelar la finca madre, aún y cuando era conocedora de la anotación del mandamiento de expropiación que ordenó este Despacho Judicial al Registro Público.
En ese tanto, téngase claro que el ámbito privado las personas administradas pueden hacer todo aquello que la ley no les impida (doctrina del art. 28 Constitucional), mas no es así cuando un sujeto de derecho ingresa dentro de una relación de sujeción especial (doctrina del art. 14.1 LGAP), y adquiere la condición de expropiado, como en el caso concreto. Toda vez que todas y cada una de sus acciones tendrán repercusiones jurídicas y materiales dentro del ámbito público (doctrina de los artículos 45 C.Pol., 11, 12, 13, 14 LGAP). Así las cosas, la segregación que llevó a cabo la expropiada sobre su finca, repercutió en la elaboración de un nuevo avalúo administrativo en el que el monto por concepto de indemnización aumentó considerablemente. Al respecto, cabe señalar que la parte expropiada, no aportó un solo elemento de prueba indóneo (sic), conducente y procedente en el que se acredite que, efectivamente, el resto de la cabida del terreno expropiado queda inhabilitado, o, incluso, supone un resto inadecuado (doctrina del onus probandi, art. 317 de la Ley 7130 del 16 de agosto de 1989, aplicable al caso concreto por ultraactividad).
Se hace especial énfasis, la parte expropiada no ha acreditado durante el trámite de estas diligencias judiciales que, el AyA hubiese infligido algún perjuicio en cuanto a la conducción de las aguas pluviales provenientes del fundo anexo y colindante hacia el Río Torres. Tanto es así que, los canales construidos por la Asociación Pro Hospital de Niños, se mantienen funcionando actualmente, y no se ha acreditado ninguna actuación activa u omisiva por parte del AyA, que imponga lo contrario. La parte expropiada no ha podido demostrar que la expropiación del lote de terreno, mude el resto de la cabida en un resto inadecuado, menos aún, un fundo enclavado "hidráulicamente", como erróneamente lo consideró el Nombre163406. , por cuanto un fundo enclavado no es otro más que aquel sin frente a calle pública. Así las cosas, en el caso concreto, está acreditado que el resto de la finca de la parte expropiada conservará un frente de 266,98 metros lineales.
Caso contrario, el ingreso y salida del lote de terreno a expropiar por parte del AyA, será mediante el terreno adyacente y colidante (sic) por el lindero oeste, sitio en el que se ubica la Planta de Tratamiento Los Tajos. Con todo, el AyA no ha impedido la escorrentía de las aguas conducidas o servidas del terreno anexo al lote de terreno a expropiar hacia el Río Torres, puesto que el único óbice que a la sazón podría presentarse a la fecha sería la topografía del terreno exclusivamente, porque en la actualidad tales aguas discurren normalmente mediante los canales construidos por la propia parte expropiada, es decir, el derecho a evacuar las aguas pluviales provenientes de fuentes naturales se mantiene incólume. Dicho de otra forma, no existen problemas a consecuencia de la evacuación de las aguas pluviales, como infundadamente lo ha sostenido la parte expropiada, a lo largo del trámite de estas diligencias.
Por otra parte, en relación con el resto de los rubros valorados, nótese que el perito judicial afirmó que no había diferendo de su parte, en otras palabras, tal y como lo concibió el AyA, el profesional validó el monto por concepto de indemnización fijada al tenor del avalúo administrativo primigenio y ulterior, inclusive. Ahora bien, sin embargo, tal y como lo acuñó el expropiante, en sus argumentos extintivos, el presunto daño al remanente invocado tanto por el perito judicial, cuanto por la parte expropiada, respecto de la finca del Partido de San José F.R. 670386-000, según el plano de catastro SJ-1824548-2015, se refiere, sino a otra finca inscrita motu proprio por la expropiada, y en tesis de principio, no guarda vínculo alguno con la inscripción de las servidumbres y expropiación valoradas en el sub lítem por el expropiante, constituidas, prima facie , sobre la finca F.R. Placa33339.
Ello, dado que registralmente no se estaría afectando la finca inicialmente contemplada, pues al efectuarse dicha segregación, las condiciones de la finca afectada sufrieron cambios, v.gr., disminución del área, forma, regularidad, dimensiones; todo lo cual, afectaría, consecuentemente, los procesos de homologación e influyen, por supuesto, en el valor unitario por metro cuadrado de la finca sujeta a estas diligencias judiciales. Todo lo cual tornó imperativa la modificación del avalúo administrativo por parte del ente público expropiante, en donde se da cuenta respecto de las nuevas características del inmueble de interés. Así las cosas, este Despacho Judicial, pudo constatar, in situ, durante el reconocimiento judicial, la existencia de los desfogues pluviales que construyó la Asociación expropiada, los cuales, no habían sufrido ninguna alteración, a consecuencia de la expropiación en autos, siendo que la parte expropiada no ha podido acreditar lo contrario mediante prueba útil, pertinente y conducente.
De tal manera que, está acreditado que la salida del agua pluvial existe a la fecha y el AyA no ha negado el derecho de evacuación de tales aguas a la finca de la expropiada. De igual modo, tal y como categóricamente lo afirma el expropiante, no hay elemento obstativo (muro o montículos) que impida la evacuación del agua pluvial por donde fluye naturalmente al sitio donde se encuentran las obras del tubo emisario, dado que esta última es aérea en ese sector (En ese sentido corrobórese lo expuesto con la fotografía No. 1 -Desfogue pluvial- del Oficio aportado por el AyA No. PRE-PAPS-2019-01658 del 13 de mayo de 2019). De idéntica forma, nótese que el canal de desfogue de las aguas pluviales, construido por la parte expropiada se mantiene en perfecto estado, según se colige de las fotografías 2 a la 5, aportadas por el expropiante, merced del memorial antes mencionado. De toda suerte, tal y como enfáticamente lo hace ver la Administración Pública expropiante, al tenor del artículo 94 de la Ley de Aguas, Ley (No. 276) del 27 de agosto de 1942, en el supuesto de que a futuro el AyA, le cercene o limite a la expropiada, la posibilidad del desfogue de las aguas pluviales, esta última se encuentra legitimada, per se, a exigir el resarcimiento de los daños y perjuicios, que tal conducta puedan (sic) depararle dentro de su esfera jurídica.
Así mismo, la solución propuesta por el Nombre163406. , es decir, la construcción de una servidumbre de paso para el desfogue de las aguas pluviales del fundo anexo por el resto de la cabida de la finca expropiada hacia el Río Torres, en efecto, adolece de sustento técnico, en virtud de que tal y como lo consigna el expropiante, aseveraciones, que, a toda luces, prohija este Despacho, por ser objetivas y contestes con las reglas de interpretación unívoca de la ciencia y de la técnica; a saber: Las condiciones hidrológicas del terreno podría variar en el transcurso del tiempo; que no sea necesaria la evacuación de las aguas producto de un desarrollo en la propiedad en cuestión, al ser este inexistente; o bien, que la calidad del agua a evacuar lleve en sí disueltas substancias nocivas o fétidas, es decir, no sean compatibles con la salud del ser humano. En fin, la construcción de la servidumbre recomendada por el señor perito judicial para supuestamente mitigar el daño al remanente ocasionado por la expropiación del lote de terreno en referencia, daño inexistente, a todas luces, conforme lo que ha sido expuesto; resulta indudablemente una acción prematura y carente de sustento técnico y legal.
A mayor abundamiento, otro punto adicional por el que nos hemos apartado del peritaje realizado por el Nombre163406. , reside en el hecho de que, aún y cuando este recomienda una indemnización de poco más de tres mil millones de colones para compensar los gastos por concepto de obras y equipos necesarios para la evacuación de las aguas por bombeo, pese a que previamente había mencionado que la cuantificación de tales gastos era imposible. Dicho de otra forma, recomienda a la ligera una indemnización tan de suyo cuantiosa, sin que se hubiese llevado cabo ningún estudio hidrológico acerca de la cuenca tributaria, habida cuenta de lo cual, sus afirmaciones rozan no sólo en la mera especulación y un hondo sin sentido, sino, además, llama la atención la falta de pericia e informalidad hilvanadas a las consideraciones plasmadas en su informe. Todo esto pese a que una vez construidas las obras inherentes al tubo emisario, no se ha acreditado ninguna inundación por parte de la expropiada dentro de su finca, ni por parte de terceros vecinos del proyecto, por cuanto la finca F.R.
Placa33228, cuenta con desfogues de aguas pluviales hacia el Río Torres, los cuales se mantienen incólumes a la fecha, tampoco existe ningún elemento material obstativo (muros, montículos u otros), que impidan el paso de las aguas pluviales. Por consiguiente, siendo que el peritaje elaborado por el Nombre163406. no tuvo el grado, la potencia, ni la resistencia jurídica para enervar la oferta económica contenida en el avalúo administrativo elaborado por la Unidad Ejecutora del AyA, sino, más bien, que ahondó en meras especulaciones y condicionó una indemnización a todas luces desproporcionada a hechos futuros e inciertos, contrario al mandato conferido por este Despacho Judicial en cuanto a la revisión objetiva y detallada del instrumento antes mencionado (doctrina del art. 35 LE). (…). Por lo pronto, se concluye que el avalúo administrativo cumple, a todas luces, con el régimen jurídico aplicable en el artículo 22 LE; (…)”.
VIII.El primer motivo de agravio esgrimido por el representante de la parte expropiada, se centra en el análisis realizado por el a quo en cuanto a la no existencia del daño al remanente y la correlativa improcedencia de la indemnización, lo que estima es erróneo, en concreto adujo las siguientes razones: El meollo del asunto, detalló, radica en que ninguno de los avalúos administrativos reconoció este daño por lo que no se les compensó, aún y cuando, se acreditó la existencia de un canal de conducción de aguas hacia el Río Torres, construido por la Asociación, con anterioridad al presente proceso, pues por la naturaleza impermeable del terreno resulta indispensable; afirmó, con la expropiación practicada, el fundo se transformó en hidráulicamente enclavado, y en adelante seguirán dependiendo de la voluntad de la expropiante para mantener la salida de aguas, por lo que el daño indemnizable es la pérdida del derecho de conducir libremente las aguas hacia el Río Torres.
En razón, de lo anterior dijo, se dio una violación a las reglas de la sana crítica racional, al no valorarse conforme a derecho el informe del Nombre163406. , quien fue consistente y claro, en la valoración del daño causado al remanente. Estima esta Cámara, los respetables argumentos del señor representante del expropiado, no resultan de recibo, en razón de lo siguiente: En primer término, el juzgador de instancia, no violentó en su resolución las reglas de la sana crítica, pues, de la lectura de las consideraciones de fondo, es posible concluir, sí analizó en conjunto la prueba recibida en los autos, tanto los informes periciales, como el reconocimiento judicial y la prueba documental que consta en el expediente, luego de lo cual concluyó no resulta posible fijar en el caso concreto indemnización alguna por concepto de daño al remanente. Explicó, el quo, de forma detallada los motivos por los cuales estimó, la valoración efectuada por el Ingeniero Peñaranda, no era apta para definir el indicado daño y desvirtuar el avalúo administrativo; así consideró, el profesional condicionó la indemnización al remanente a un hecho futuro e incierto, y consecuentemente las supuestas mejoras para evacuar el agua que cae en la finca, también resultan eventuales; fue enfático en que, la situación del emisario construido en el 2015, de forma alguna impide el desfogue de las aguas por los canales construidos por la hoy recurrente, con anterioridad al presente proceso, y permiten su discurrir hacia el Río Torres, externó, los mismos se mantienen funcionando actualmente y no se ha acreditado ninguna actuación activa u omisiva por parte del AyA, que imponga lo contrario, lo cual adicionó, fue constatado por ese Despacho Judicial, in situ, durante el reconocimiento judicial, y además sustentó su consideración, en el Oficio aportado por el AyA No. PRE-PAPS-2019-01658 del 13 de mayo de 2019 y en las fotografías 2 a la 5, aportadas por el expropiante, con el memorial citado.
En cuanto a la inversión que dijo el profesional, deberá la expropiada eventualmente realizarlas en sistemas onerosos y de difícil operación para la disposición de dichas aguas, resaltó el juzgador, lo informal de ese criterio, toda vez que, el propio experto, manifestó era imposible cuantificar el valor de las obras y equipos necesarios para su evacuación mediante sistema de "bombeo", hasta tanto no se realice el estudio hidrológico detallado de la cuenca tributaria para establecer los caudales de escorrentía; además calificó de contradictorio el informe, pues por otro lado y en forma paralela, afirmó que dicha solución -mejoras para el desfogue de las aguas pluviales- sería impráctica y carente de sentido, debido a que el Río Nombre8875 figura como el límite natural al cual se puede acceder a través de una servidumbre de paso para descargar las aguas por gravedad. Advirtió, el juez, el perito judicial matriculó su tesis en meras especulaciones, porque presume se debe constituir una servidumbre de paso de aguas por la zona expropiada, sin ninguna base técnica ni científica, lo que resulta contrario a la doctrina del canon 16.1 y 136 LGAP.
En lo que refiere al quantum por concepto del daño al remanente, establecido por el profesional en la suma de ¢3.607.015.014,60 (Tres mil seiscientos siete millones quince mil catorce colones con 60/100), el cual afirmó se fijó con sustento en el 30% del valor dado en el avalúo administrativo, consideró el a quo, carece de sustento técnico real y objetivo, además lo calificó como desproporcionado e irrazonable y representa un lucro desproporcionado a favor del expropiado, contrario a lo dispuesto en el numeral 22 de la Ley de Expropiaciones; adicionó, el peritaje realizado por el Nombre163406. , recomendó una indemnización de poco más de tres mil millones de colones, para compensar los gastos por concepto de obras y equipos necesarios para la evacuación de las aguas por bombeo, pese a que previamente había mencionado que la cuantificación de tales gastos resultaba imposible. Concluyó el juzgador, luego del análisis de la pericia del Nombre163406. , este no tuvo la potencia, ni la resistencia jurídica para enervar la oferta económica contenida en el avalúo administrativo, pues, se basó en meras especulaciones y condicionó una indemnización a todas luces desproporcionada a hechos futuros e inciertos, contrario al mandato conferido por ese Despacho Judicial en cuanto a la revisión objetiva y detallada del instrumento antes mencionado (doctrina del art. Placa33336 ).
Tal y como es posible apreciar del recuento realizado, el Juzgador ahondó en razones para sustentar el rechazo a la indemnización por daño al remanente, fue claro en su razonamiento y comprensión de la posición adoptada por el perito judicial en cuanto a la naturaleza del fundo restante, calificada como “hidráulicamente enclavado”, lo cual no avaló por las razones indicadas, tomando además en consideración otros elementos de prueba que se hicieron llegar al expediente.
IX.Por otra parte, es importante señalar, no se considera de recibo el agravio realizado por el señor representante de la expropiada, en el sentido de que: “el a quo se aprovechó de la desidia del perito tercero en discordia, que llevó a que sus valoraciones no se tomaran en consideración”; lo cierto del caso es que el nombramiento inicial este experto, se dejó sin efecto en auto dictado por el Juzgado de Instancia, a las 08.42 horas del 22 de febrero de 2019, toda vez que el Ing. Luis Amadeo Alvarado Boirivant, omitió verter su criterio técnico respecto del nuevo avalúo administrativo, emanado de la Unidad Ejecutora del AyA; en esta misma resolución, se confirió audiencia a las partes para que manifestasen si requerían o no el nombramiento de otro experto tercero en discordia, gestión que ninguna de ellas promovió, así como tampoco existió inconformidad por parte del hoy recurrente, sobre lo resuelto en el indicado auto; es la falta de esta petición de las partes interesadas, incluido el expropiado, lo que impidió tener un criterio técnico diferente a los ya rendidos, de forma tal que el juez se vio en la obligación de resolver con sustento en las pruebas que constaban en el expediente, sin que con ello se advierta una posición indebida de aprovechar lo acaecido en lo que respecta a esta prueba, menos aún es posible advertir indefensión al recurrente.
En otro orden de ideas, tampoco resulta de recibo el reproche realizado, en cuanto a la falta de fundamentación del avalúo administrativo de fecha 11 de junio del 2018 elaborado por la Unidad Ejecutora del AyA, N°PREP-PAPS-2018-02246, donde señaló el recurrente, simplemente se limitó la Administración a decir que el valor del daño al remanente era igual a cero; ello no resulta acorde con la prueba que consta en el expediente, si bien, en el cuerpo del peritaje únicamente se indicó que se aplicó el método del antes y el después, para la determinación del daño al remanente, lo que tuvo como resultado una valoración de cero colones, lo cierto es que, allí mismo se refirió al anexo 8 de las hojas de trabajo, a efecto de constatar la explicación de la valoración efectuada; revisados los autos, se tiene que en ese anexo, presentado en forma conjunta con el avalúo administrativo, se dio la siguiente justificación: “ De acuerdo con los cálculos realizados el valor por metro cuadrado de la propiedad aumenta después de la segregación, debido principalmente a la mejor regularidad que adquiere la propiedad, ya que se está eliminando una “colita” de la finca, la cual antes influía negativamente en la regularidad, pasando de un factor 0.836 a 0.896.
Otro factor que aumenta el valor por metro cuadrado es el de la relación de áreas, ya que la cantidad de área de la finca disminuye, por lo que la relación con las propiedades a homologar tiende a aumentar. Ahora bien, realizando la diferencia entre los valores de la finca Antes y Después, obtenemos: ¢11 132 614 477, 06 - ¢12 023 383 382.00 = -¢890 768 905.16. El valor resulta negativo, lo que indica que no se debe pagar daño al remanente, pues la finca al segregar el área indicada en el plano SJ-1631901-2013 obtiene una forma más regular, lo que ayuda a aumentar el valor por metro cuadrado resultante y por consiguiente un valor total mayor. (Anexo 8 imágenes 336-337 del expediente electrónico principal). Sobre estos aspectos de orden técnico no se realizó agravio alguno, que permita analizar lo justificado por la Administración en cuanto a la valoración del daño al remanente, a partir de la metodología del antes y el después.
Por otro lado, se debe advertir, además, tampoco existe prueba que permita establecer una pérdida o afectación a la actividad actual y real de la Asociación y a la proyección económica del bien remanente; es más, durante la celebración de la audiencia oral, el representante de la parte expropiada, reconoció se trata de un terreno que se encuentra en el sector Oeste del Parque de Diversiones, que no tenía un uso particular, dijo, fue una zona de tajo, que se ha utilizado por el Parque para realizar eventos al aire libre; en realidad bajo estas condiciones, no comprende el Tribunal, la afectación que se acusa provoca la expropiación del lote de 12 135 metros cuadrados, a la proyección económica del bien o a su uso actual, las condiciones se mantienen, el uso no se ha modificado, por lo que en esencia no existe un daño actual, susceptible de ser indemnizado, conforme al artículo 22 in fine de la Ley de Expropiaciones, N°7495 y sus reformas.
X.Daño al Remanente por Constituirse un Fundo Hidráulicamente Enclavado: Ahora bien, esta Cámara coincide en esencia con el criterio vertido por el a quo, en cuanto a la inexistencia del daño al remanente en los términos vertidos por el perito judicial Nombre163406. , en tanto estableció su procedencia a partir de la figura de un fundo “hidráulicamente enclavado”. Al respecto debe indicarse, el daño indemnizable que se causa a un fundo -en forma directa o indirecta- por la expropiación parcial del terreno o bien por la constitución de una servidumbre sobre el mismo, se reconoce a partir de la pérdida de deseabilidad provocada sobre el fundo que permanecerá en cabeza del expropiado, lo que se ha denominado “Daño al Remanente”, ello podrá obedecer a múltiples razones, ligadas en su gran mayoría a la disminución o desaparición de factores valorizantes del terreno, verbigracia: pérdida de frente a calle pública, irregularidad en su forma, pérdida de vista panorámica o belleza escénica, pérdida de fuentes de agua en terrenos con vocación agrícola o agropecuaria, supresión del acceso directo a calle pública, o bien limitaciones impuestas al fundo provenientes de la constitución de servidumbres, en cuanto al uso y disfrute del bien; aspectos sobre los cuales se ha admitido la indemnización tanto en sede administrativa como judicial; en todos los casos, los daños deberán ser reales y permanentes, sin que resulte posible tomar en consideración para su determinación, hechos futuros, ni las expectativas de derecho -artículo 22 in fine de la Ley 7495 y sus reformas-.
Lo anterior se convierte en un límite infranqueable, tanto para la Administración como para los Órganos Jurisdiccionales, que intervienen en la determinación del justo precio conforme a lo dispuesto en el cuerpo normativo de cita. En la especie, es precisamente esta limitación, la que impide de forma primigenia, reconocer el daño al remanente reclamado por el hoy recurrente, nótese, constituye un hecho no controvertido, la obra que dio origen al presente proceso expropiatorio denominada “Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José”, fue construida en su totalidad por el Instituto Costarricense de Acueductos y Alcantarillados, esto en lo que interesa, en la colindancia oeste del Parque de Diversiones, desde el año 2015. Los emisarios, tubería que transporta por gravedad el agua proveniente de cuatro colectores principales -Nombre280, Nombre8875, Nombre163407 y Nombre91549- hasta la planta de tratamiento Los Tajos, fueron instalados en cotas de elevación, lo que es posible apreciar de las diversas fotografías que se hicieron llegar al expediente y el reconocimiento judicial practicado, así como en los diferentes informes presentados en sede jurisdiccional; tales obras no constituyen un obstáculo para el discurrir de las aguas provenientes del fundo remanente.
Por otra parte, también constituye un hecho no controvertido, los canales de desfogue pluviales hacia el Río Torres, construidos por la Asociación recurrente, con anterioridad a la presente expropiación, mantienen hasta la fecha la utilidad para la cual fueron creados, más aún, se acreditó, el expropiante instaló en el terreno expropiado, dos alcantarillas con diámetros de 106 y 45 centímetros respectivamente, que permiten el desfogue en forma eficiente – informe PRE-PAPS-2019-01658, imágenes 162 y fotografías 163 y 164 del expediente electrónico principal- tanto así, que a la fecha no existe reclamo alguno relacionado con problemas de inundación del terreno. Esta información, que consta en los autos, y que se insiste constituyen hechos no controvertidos, da fe que las condiciones de desfogue fluvial hacia el Río Torres, propias del remanente se mantienen incólumes, con la ventaja desde el punto de vista probatorio, que la obra en el sector en discusión se concluyó hace aproximadamente siete años, lo que permite tener claridad de sus estructuras y dimensiones, compatibles con los canales existentes.
La lectura del informe del perito judicial, Ing. Peñaranda, parte de una condición que desde el punto de vista jurídico, no es posible valorar, y es derivar el daño al remanente de un hecho futuro e incierto, cual es la imposibilidad de desfogue de aguas hacia el Río Torres, incluso hace referencia a la eventual necesidad de tener que acudir a mecanismos de desfogue por bombeo, que él mismo reconoce no puede dimensionar en cuanto a su costo económico y practicidad, debido a la necesidad de mayores estudio hidrológicos, de manera literal expresó: “(…)Que la estimación del valor de las obras y equipos necesarios para la evacuación de las aguas por “bombeo” es imposible de cuantificar hasta tanto no se realice el estudio hidrológico detallado de la cuenca tributaria para establecer los caudales de escorrentía. Que además, esta solución a todas luces impráctica y carente de sentido teniendo el Río Nombre8875 como un límite natural al cual se puede acceder a través de una servidumbre de paso para descargar las aguas por gravedad (…)”– informe pericial del 23 de abril del 2019, imagen 180 del expediente electrónico principal-.
Tal y como lo apuntó el juzgador de instancia en su resolución, la ambigüedad del informe y su falta de determinación, de manera irremediable le resta credibilidad. Se parte además de una presunción de mala fe de la Administración, de modificar su comportamiento actual de colaboración abierta y seria con el desfogue de aguas -que además resulta compatible con la obra realizada- por una posición restrictiva al respecto. Obsérvese, por principio general del derecho la buena fe siempre se presume, en tanto la mala fe debe necesariamente acreditarse; en la especie, la conducta emanada de la entidad expropiante, analizada desde el principio de confianza legítima -artículo 137 de la Ley General de la Administración Pública- da fe que el comportamiento de la Administración expropiante, se encuentra dirigido a mantener las condiciones de desfogue de aguas pluviales encontradas al momento de la expropiación, incluso, como se señaló líneas arriba mejorándolas; lejos de ello, no encuentra esta Cámara prueba alguna que permita derivar un comportamiento contrario a futuro, en concordancia con lo anterior, no se encuentra razón jurídica para imponer una servidumbre para descargar las aguas, como lo enuncia el Nombre163406. , pues dadas la condiciones actuales, las aguas siguen discurriendo por las infraestructuras construidas al efecto, sin inconveniente.
Durante la celebración de la audiencia oral de apelación, el representante de la Asociación expropiada, expuso que el daño reclamado, es la pérdida del derecho de continuar conduciendo las aguas, entiende el Tribunal, en forma libre, sin tener que depender de la voluntad administrativa, sin embargo, ello constituye también un hecho futuro e incierto, pues, en concordancia con lo ya expuesto, la Administración, hasta la fecha ha mantenido incólume la conducción de aguas, por los canales preexistentes, en la eventualidad que se las condiciones del terreno se modifiquen o bien resulte necesario intervenir los canales o alcantarillas, se deberá acudir a los mecanismos que el ordenamiento jurídico permite, a efecto de solventar esas eventuales situaciones. Finalmente, no puede dejar pasar por alto esta Cámara, el hecho de que el valor fijado por concepto de daño al remanente por el Nombre163406. , carece por completo de fundamento técnico, nótese, se estableció una disminución en el valor del bien del 30%, sin explicar el origen técnico de ese porcentaje, que lleva a una indemnización superior a los tres mil millones de colones, así se limitó a señalar el profesional: “(…)Estimo el daño al remanente en el 30% del valor dado por el documento del Ing. Koying Ng, en razón de que su homologación en el ejercicio de valores antes y después no considera en sus comparables que el predio valorado carece de libertad para desaguar sus aguas y por lo tanto su valor de mercado es muy inferior a aquellos comparables que si gozan de esa condición, por lo tanto, es mi criterio, que se debe indemnizar a APHNN en la suma de colones 12.023.383.382x0,3= colones 3.607.015.014.60 (tres mil seiscientos siete millones quince mil catorce colones con sesenta céntimos), ya que no de otra manera no es posible determinar el costo de construcción de las obras de infraestructura para la evacuación de aguas y su costo de operación en el tiempo(…)”.( informe pericial del 23 de abril del 2019, imagen 181 del expediente electrónico principal).
El monto así fijado, además, resulta ambiguo, incluso contradictorio, pues por una parte se manifiesta que representa la pérdida de deseabilidad del bien al carecer de libertad para desfogar sus aguas, y por otro lado, concluye que no existe otra forma para definir el costo de construcción de las obras de infraestructura; esta indefinición y falta de fundamentación, constituye un óbice adicional para aceptar la valoración realizada por el Nombre163406. . Se comparte el criterio externado por el juez de instancia, lo anterior es contrario a las reglas de la ciencia y la técnica, que conforme al artículo 16 de la Ley General de la Administración Pública, deben sustentar el quehacer de la Administración, los órganos jurisdiccionales y también de los peritos judiciales, quienes en su quehacer son auxiliares de la Administración de Justicia, en este caso, a efecto de determinar el justo precio.
XI.Conclusión: En razón de lo expuesto, el recurso de apelación formulado por el señor representante de la parte expropiada, debe ser rechazado en su totalidad, toda vez que, sus respetables argumentos carecen de fuerza a efecto de revertir la decisión tomada, la cual deberá confirmarse.-
POR TANTO:
En lo que ha sido objeto de recurso, se confirma por las razones dadas, la sentencia dictada por el Juez Billy Araya Olmos, N°1279-2021-E de las 14:03 horas del 24 de junio de dos mil veintiuno, aclarada mediante resolución de las 10:58 horas del 21 de setiembre del 2021.
