[Nombre 002] Decision number 54-2022 TRIBUNAL DE APELACIÓN CIVIL Y TRABAJO DE GUANACASTE (SEDE LIBERIA) (Civil Matters).- At fourteen hours and ten minutes on February sixteenth, two thousand twenty-two.- HEADING BOUNDARY-RESTORATION SUMMARY POSSESSORY PROCEEDING (INTERDICTO DE REPOSICIÓN DE LINDEROS), being heard by the Juzgado Civil y Trabajo del II Circuito Judicial de Alajuela, Upala seat (Civil Matters), under case-file number 20-000044-1143-CI, brought by [Nombre 001] against [Nombre 002]. The parties’ particulars and addresses are as stated in the record. Lic. [Nombre 003], bar membership number [Valor 001], participated as counsel for the plaintiff, as did Lic. Mauricio Rodríguez Méndez, bar membership number 7.121, as special judicial attorney-in-fact (apoderado especial judicial) for the defendant.

CONSIDERING
The plaintiff filed a possessory-protection summary proceeding (interdicto de amparo de posesión), in which the following relief was requested (quoted verbatim):
"FIRST: I request that the boundaries of my property, as previously established, be restored to their original condition and that the dividing fence marking the boundary between the properties be rebuilt.
SECOND: I request that a retaining wall (muro de contención) be constructed on the slope created by the earthworks (movimiento de tierra), in order to safeguard the integrity of the land and prevent greater damage to my land.
THIRD: I further request that your authority appoint a court expert (perito del despacho) specializing in environmental damage to perform the relevant assessments in the area, thereby making it possible to estimate the amount in controversy (cuantía) in this action, since that estimate can be made only after an on-site investigation to determine the extent of the impact and the costs of removing that material.
FOURTH: I request that your authority appoint an expert specialist and order an expert appraisal (peritaje) to estimate the damages and losses (daños y perjuicios) that I sustained as a result of these unauthorized earthworks. I further request that the defendant be ordered to pay those damages and losses.
FIFTH: I request that notices of lis pendens (anotaciones) be entered against the properties of Mr. [Nombre 002], which appear in the property registry under the following property numbers in the province of [Nombre 004]: [Valor 002], [Valor 003], [Valor 004], [Valor 005], [Valor 016] [Valor 007],[Valor 008], [Valor 009], [Valor 010], [Valor 011], [Valor 012], [Valor 013], [Valor 014]. I further request that all bank accounts, deposits, or shares held in the national banking system in the name of Mr. [Nombre 002] be attached so that they may secure payment for the damages and losses caused to my property.
SIXTH: I request that your authority investigate the substantive truth (verdad real) concerning the acts committed and/or the persons involved in said harm.
SEVENTH: I request that this boundary-restoration summary possessory proceeding be granted.
EIGHTH: I request that the defendant be ordered to pay procedural costs and attorney fees (costas procesales y legales)" (sic).
By means of a filing added to the electronic case file on 05/08/2020 02:05:30, the defendant answered the action brought against him. He expressly consented to the first item of the prayer for relief (petitoria) and requested that the remaining relief sought be denied. He requested exemption from the payment of costs because he was fully willing to repair the damage caused and to litigate in good faith. He also requested that the plaintiff be ordered to pay cotas.
The Judge of the Juzgado Civil y Trabajo del II Circuito Judicial de Alajuela, Upala seat (Civil Matters), Lic. Jainer Alonso Gamboa Muñoz, ruled as follows in judgment number 2021000071, issued at 12:21 on 01/10/2021:
"Por tanto:
The Boundary-Restoration Possessory Action filed by [Nombre 001] against [Nombre 002] is granted. The defendant is ordered to restore the northern boundary of the plaintiff’s property, with a view to returning it to its original condition, delimiting it with a dividing or retaining fence along that boundary. He is ordered to construct a retaining wall along the boundary of his property, extending across every section altered by the earth fill placed against the plaintiff’s property. Its dimensions shall be determined through technical expert evidence (prueba técnica pericial), defining the effect of the soil or the pressure it may exert, as well as any undermining caused by rainwater or stormwater that may flow toward the defendant’s land, in order to determine the appropriate specifications for whether a retaining wall must be built; and the possible damage sustained by the plaintiff’s real property and its quantification. If such damage exists, it must be assessed by a civil or structural engineer, who shall specify the requirements for the work to be performed along the boundary between the parties’ properties and any soil study that may be required. The engineer shall also state the total value or costs of the work to be performed, which, once determined, shall be carried out by the defendant at his own expense. The period within which the work must be completed shall be determined once the aforementioned report has been submitted. If the defendant does not perform the specified containment work, the plaintiff shall be authorized to have it performed at the expense of the unsuccessful party, together with payment of any damages and losses that this may cause. The foregoing shall be determined during the judgment-enforcement stage (etapa de ejecución de sentencia). The defendant shall be liable for the damages and losses caused, which shall be determined during the judgment-enforcement stage. Attorney fees and procedural costs (costas personales y procesales) shall be borne by the unsuccessful party" (sic).
Article 67.5 of Ley N° 9.342/2016 Código Procesal Civil provides that "Judgments, except those issued in ordinary proceedings involving larger amounts in controversy, may be appealed." In this case, the record shows that the appealed judgment was issued in a summary possessory proceeding (proceso sumario interdictal), and the appeal is therefore proper.
Second, it must be determined whether the objection was raised within the statutory period, which, pursuant to Article 67.1, second paragraph, of the Código Procesal Civil currently in force, is five days. It should be recalled that the time limits run jointly for all parties, and therefore must be calculated from the time all parties were served (as construed from Articles 10 and 38 of Ley de Notificaciones Judiciales, N° 8.687/2009). In this case, the notices were transmitted to all parties on 01/10/2021 by email (see certificates of service included in the electronic case file).
Furthermore, pursuant to Section 38 of Ley N° 8.687/2009, when electronic means are used, a person is deemed served on the business day following transmission, and the time limit begins to run on the business day following service upon all parties. Consequently, service upon all parties occurred on 04/10/2021, and the period for filing an appeal ran from 05/10/2021 to 11/10/2021. It can be verified that the dissatisfied party filed its appeal on 11/10/2021 03:06:02, within the period granted for that purpose.
Finally, in its appeal, the appellant stated the reasons why it believes the appealed decision should be modified, thereby satisfying the established admissibility requirements.
The defendant expressed disagreement with the trial court’s ruling. For the sake of brevity, the appeal is transcribed below:
"I, the undersigned, LIC. MAURICIO RODRÍGUEZ MÉNDEZ, whose particulars are known in the record, acting as Special Judicial Attorney-in-Fact for the Defendant, respectfully appear before your Authority and state:
APPEAL WITH CONCURRENT NULLITY CLAIM (NULIDAD CONCOMITANTE) I formally file an APPEAL WITH CONCURRENT NULLITY CLAIM against TRIAL-COURT JUDGMENT 2021000071, issued at 12:21 on 01 de Octubre del 2021, because we disagree with it, based on the following:
GROUNDS FOR APPEAL:
The following substantive challenges, grievances, objections, and errors are asserted against the appealed decision.
Articles 277,305, 307 of the Código Civil and 106 through 108 of the Código Procesal Civil collectively govern summary possessory relief (tutela interdictal). Section 106 of the C.P.C. states with complete clarity: "Summary possessory proceedings shall apply only to the present and immediate possession of real property. They shall under no circumstances affect questions of ownership or definitive possession, concerning which no discussion whatsoever shall be admitted..." In other words, "possessio ad interdicta" (posesión ad interdicta) is protected (Meza, Lázanls, Alvaro. Tratado de la Posesión, 2da edición, Isolma, 2015, páginas 166 y siguientes), meaning the present and immediate possession of real property. This summary possessory action should have been summarily dismissed without passing the admissibility screening because this is not a matter involving interference with the plaintiff’s right of possession, and the facts alleged in the complaint are not characteristic of, or appropriate for, summary possessory relief. Instead, this would constitute an independent declaratory action for damages and losses that must be heard and decided in declaratory proceedings (proceso declarativo) (Article 101 of the C.P.C.).
A reading of the complaint reveals that none of its allegations or events refers to conduct by the defendant ([Nombre 002]) that interferes with or infringes the plaintiff’s right of possession, or reflects an intention by the defendant to dispossess the plaintiff of his present or immediate possession. Indeed, the plaintiff did not allege that he possessed the real property or submit the corresponding evidence, since a certificate of ownership is not a suitable or useful means of proving or establishing present and immediate possession.
Pursuant to Section 41.1.1, the burden of proof (carga de la prueba) lies with the person asserting a claim as to the facts establishing that person’s right. Accordingly, the plaintiff had the burden of proving: i) present and immediate possession of the real property; ii) acts interfering with that present and immediate possession that were imputable or attributable to the defendant; and iii) that those interfering acts were intended to dispossess the plaintiff of present and immediate possession of the property. That trilogy of elements was neither introduced into the proceeding nor discussed at the single hearing (audiencia única) held for that purpose. The course of the summary possessory proceeding—as permitted by the Judge—turned to matters exceeding or going beyond summary possessory relief. What was discussed in the proceeding was the defendant’s performance of certain earthworks that caused the fence or boundary marker to collapse and some rubble or material to fall onto the land of the adjoining owner and plaintiff. We do not doubt that some degree of discomfort or inconvenience was caused to the plaintiff, but it is evident that such conduct or behavior was not motivated by an intent to interfere with the plaintiff’s possession.
The judgment under appeal unlawfully orders the defendant to perform affirmative obligations that are not proper to an interdict proceeding (proceso interdictal), whose scope is defined and limited to protecting the plaintiff’s current and temporary possession (posesión actual y momentánea); that is, the ruling must address a claim seeking to prevent the defendant from engaging in disturbing acts (actos perturbatorios) that interfere with or impair the claimant’s possession and must likewise order, pursuant to 309 of the Código Civil, that the defendant henceforth refrain from committing such acts, under penalty of being charged with the offense of disobedience of authority. It shall likewise award damages (daños y perjuicios) if they are proven. As to the latter, however, the judgment is plainly and manifestly mistaken insofar as it awards damages beyond the functional jurisdiction of a judge in summary proceedings (proceso sumario), such matters properly belonging in declaratory proceedings (materia declarativa). In this regard, our Courts have held:
"...It is true that all possessory interdicts (interdictos) allow recovery of damages, as established by article 460 of the aforementioned body of laws. Nevertheless, it must be understood that such a claim within summary proceedings is ancillary to the principal claim, that is, the subject matter of the dispute must fall within the scope of an interdict. Otherwise, damages emerge as the principal claim and, as such, lack a specific procedural mechanism. For that reason, provisions 287 and 421 ibidem become applicable, requiring the interested party to seek them through declaratory proceedings... ( Voto número 457-L, Tribunal Primero Civil de San José, de las 8:15 horas del 10 de mano de 2000, in the same regard, see the same Tribunal’s voto No. 897-M.)
In the present case, the judgment under appeal awarded damages and imposed obligations upon the defendant, in evident infringement and violation of substantive and procedural law by the adjudicating Court, because although provision 106.5 of the Código Procesal Civil authorizes an award of damages, they may be awarded only when they constitute a claim ancillary to the principal subject matter—the principal claim—which must be interdict protection. That is, only damages directly and immediately related to acts disturbing or impairing possession are compensable, but not other damages, however serious or extensive they may be; the injured party must resort to declaratory proceedings. This follows from the structure of the summary proceedings in which interdicts are heard (103.1.3 of the Código Procesal Civil), which does not provide for the possible adjudication of damages in any of its 14 subsections; declaratory proceedings must be pursued for that purpose.
Our courts have been consistent and uniform on this matter: "III. In the complaint, which begins at folio 26, the plaintiff company claims that, when the defendant prepared the adjoining land for construction, it destroyed part of the boundary wall that had existed for several years. That is the subject matter of the dispute, and it is evident that such a claim is not proper to summary proceedings for possessory protection (protección posesoria), such as interdicts. The set of photographs submitted throughout these proceedings shows that the appellant did in fact construct premises along the western boundary of the plaintiff’s property and, when removing earth to prepare for construction, damaged the boundary wall located along that boundary. Under article 457 of the Código Procesal Civil, an interdict action (demanda interdictal) is by nature limited to the possibility of protecting actual or temporary possession, without questions of ownership or definitive possession being raised.
The defendant’s conduct could give rise to a claim for damages in declaratory proceedings (ordinary or abbreviated, depending on the amount in controversy). It is true that all interdicts allow recovery of damages, as established by article 460 of the aforementioned body of laws. Nevertheless, it must be understood that such a claim within summary proceedings is ancillary to the principal claim, meaning that the subject matter of the dispute must fall within the scope of an interdict. Otherwise, damages emerge as the principal claim and, as such, lack a specific procedural mechanism. For that reason, provisions 287 and 421 ibídem become applicable, requiring the interested party to seek them through declaratory proceedings. The relief requested at folio 29 actually seeks an order compelling performance together with damages, which falls outside summary proceedings. It requests that the defendant reconstruct the destroyed boundary wall using the same form, materials, and dimensions.
Under those circumstances, the complaint could properly have been summarily denied for reasons of procedural and financial economy, both for the parties... In that regard, in a case similar to the one before us, it was held: ‘the appealed ruling accords with the law and the merits of the case, and the grievances asserted by the plaintiff-appellant are without merit. According to the initial complaint, the factual circumstances in dispute are limited to the work performed by the defendant on a party wall (pared medianera), which consisted of exceeding the established limits by raising the roof of her kitchen above the roof of the plaintiff’s property. To do so, the complaint adds, she detached the zinc sheets and left them that way. Those facts unquestionably do not constitute matters proper to an interdict and, therefore, for reasons of procedural economy, the matter should not proceed through summary interdict proceedings.
The Tribunal does not question the possibility that the work performed caused inconvenience, but it in no way demonstrates an intention by the defendant to dispossess the plaintiff. If there were any “disturbance,” it would not fall within the field of possessory protection but within other areas, and it could give rise to damages to be adjudicated in declaratory proceedings... .’" (Voto número 457-L, Tribunal Primero Civil de San José, de las 8: 15 horas del 10 de marzo de 2000, in the same regard, see the same Tribunal’s voto No. 897-M de las 7:45 horas del 20 de julio de 2001).

That prohibition is justified because what matters in these proceedings is possessory protection, and for that purpose the plaintiff must establish mere holding or de facto possession (posesión de hecho) of the land in dispute. The record lacks suitable evidence in that regard, and submission of a duly registered ownership certificate and witness statements concerning ownership is insufficient. Indeed, the complaint itself fails to state what the acts of possession consisted of, and the testimony likewise makes no reference to that important aspect. To the contrary, the evidence presented shows that this is plainly a dispute over title to an adjoining area, that is, the precise location of the boundary.....Under those circumstances, properly understood, the claim seeks not possessory protection but ownership of a strip of land, a dispute falling outside summary proceedings. Declaratory proceedings must be pursued..." Another decision held:
"...the listed facts fall outside possessory protection and, by their nature, could be characterized as causes giving rise to damages, which must be adjudicated in declaratory proceedings. Indeed, the construction of the wall at issue, as may be seen from the set of photographs and as the plaintiffs themselves acknowledge, does not alter the boundary because it was built at some distance from the existing boundary walls. Nor is it possible to assess the quality of its construction as a disturbing act. It is evident, however, that the wall and the resulting fill, by virtue of their ultimate effect, have caused some inconvenience to the adjoining plaintiffs, and it is possible that the reported events occurred to their full extent. Nevertheless, they are not the result of acts that interfere with possession or demonstrate an intention to dispossess the plaintiffs of their properties... The same occurs when an adjoining property is built or repaired and some debris remains on the roof and obstructs the gutters.
In that factual situation, the presence of the debris is not a matter for an interdict because, as in the preceding example, those are not acts that interfere with possession, much less acts intended to dispossess... TRIBUNAL PRIMERO CIVIL, Voto No. 1681-E de las 7:45 horas del 21 de diciembre de 1994 and, from the same Tribunal, voto No. 111 de las 8:35 horas del 25 de enero de 1995.
Consequently, the decision of the lower court contained in the judgment under appeal, ordering the defendant to: "...construct a retaining wall along the boundary of his property, extending across every portion showing alteration due to the placement of earth fill in relation to the plaintiff’s property; its dimensions shall be determined through technical expert evidence (prueba técnica pericial) defining the effect of the earth or the pressure that it may exert, or of any erosion caused by rainwater or stormwater that may flow toward the defendant’s land, in order to determine the conditions governing whether or not a retaining wall must be constructed...", is entirely contrary to law and to the cited judicial precedents. In other words, given the structure of summary proceedings, their evidentiary limitations, the single hearing, and the impossibility of conducting fully adversarial proceedings (contradictorio pleno), such a claim cannot be granted in an interdict proceeding whose sole purpose, as established by legal scholarship, legislation, and case law, is to adjudicate current and temporary possession of real property.
The judgment is plainly excessive and violates article 106 of the Código Procesal Civil, which limits the dispute or adversarial proceedings to the "current and temporary possession of real property. Under no circumstances shall they affect questions of ownership or definitive ownership, concerning which no dispute whatsoever shall be admitted..".
In the case at bar (subjudice), no issues concerning current or temporary possession were adjudicated, nor were any alleged disturbing acts or any intent or purpose on the part of the defendant to dispossess the plaintiff. Those matters, which are the matters that may be adjudicated in summary interdict proceedings, are entirely absent. The adjudicator allowed matters outside or beyond the scope of an interdict to be adjudicated. Upon reviewing the complaint, the evidence offered, and the single hearing, we see that the matter concerned the damages that may have been caused to the plaintiff and whether they were proven by the evidence submitted. That matter should not have been heard in summary proceedings; the judgment must therefore be vacated for infringement of essential procedural rules, because matters properly belonging in declaratory proceedings were heard and decided through summary proceedings.
Indeed, the procedural codifier established the proceedings and claims that may be heard therein and, as a residual mechanism, provided for declaratory or ordinary proceedings for all matters lacking a special proceeding. Provision 103.1 of the C.P.C. does not provide for the adjudication of damages in summary proceedings; rather, they must be adjudicated in ordinary proceedings. Accordingly, the adjudicator’s decision to grant relief that is not proper to interdict proceedings necessarily gives rise to the ABSOLUTE NULLITY AND INEFFECTIVENESS OF THE JUDGMENT, because the Appellate Court could not adjudicate the matter as a court of sole instance.
We also challenge the award of unliquidated damages, without limiting it to the principal claim, which would be possessory-injunction relief (tutela interdictal), rather than an independent action for the recovery of damages, for all the reasons set forth supra and to avoid repetition. Such an award is not possible because possessory-injunction relief was not litigated in this proceeding; instead, strangely, the trial judge issued a judicial decision entirely lacking any legal or factual basis, since the alleged facts (cause of action (causa petendi)) did not even include acts of interference (actos perturbatorios) intended to dispossess the plaintiff of his present or temporary possession. In the reasoning portion of the ruling, the Court does not consider the possible impairment or infringement of the plaintiff’s possession for purposes of possessory relief (posesión ad interdicta), or his present or temporary possession, but instead proceeds as though this were an ordinary proceeding, assesses the evidence submitted in the case, and, unacceptably, issues a judgment granting claims that are not proper to a possessory injunction (interdicto).
Thus, if the damages that may be awarded must be ancillary, in this case they are awarded as principal relief, since the main object—possessory-injunction relief—was not granted. The ruling therefore suffers from the serious defect of incongruity (incongruencia), because there must be a close relationship between the grounds for relief and the claim. In the present matter, there are no facts concerning interference with present and temporary possession, the manner in which that possession is allegedly being disturbed, or whether such acts are intended to dispossess the plaintiff. Because those essential facts were neither alleged nor proven, the Court cannot, without violating the requirement of congruity, grant relief that would qualify not as ancillary but as principal relief; this is another ground for vacating the ruling.
(GROUND FOR REVERSAL) Lack of reasoning and improper assessment of the evidence. The A QUO improperly applies Article 106.4 of the Código Procesal Civil, concerning the Action for Restoration of Boundaries (Interdicto de Reposición de Linderos).
“106.4. Restoration of boundaries. An action for restoration of boundaries shall lie when the boundaries between properties have been altered. The injured party shall bring the claim against the person who committed the act, the person who benefited from it, or both.
A judgment granting relief shall order the boundaries restored to their original condition. The costs entailed by the replacement or restoration shall be borne by the person responsible for the alteration or by the person who benefited from it, as the court deems appropriate. If the defendant admits that the alteration occurred but denies having caused it, or if the person who caused it cannot be identified, restoration may be ordered at the expense of the plaintiff and the defendant or defendants, as applicable. If the judgment is not complied with voluntarily, enforcement shall proceed in accordance with the provisions governing judgments requiring the performance of an act.” FACTS FOUND PROVEN BY THE A QUO:
We believe that the FACTS FOUND PROVEN by the A QUO are insufficient to support the type of award set forth in the JUDGMENT UNDER APPEAL, for the following reasons:
Regarding the FACTS FOUND PROVEN, of which there are ONLY TWO, we may state:
AS TO THE FIRST:
It merely recognizes that the parties’ properties are adjoining.
AS TO THE SECOND:
This finding states, insofar as relevant:
“2. [Nombre 002] performed earthworks (movimientos de tierra) on his property, and as a result of that action, a portion of the soil slid onto the plaintiff’s property; the earthworks were performed without a municipal permit (...).” Regarding this proven fact, the A Quo states, insofar as relevant:
“...There is full agreement that the defendant performed work on his property involving earthworks, which, even though their dimensions were not specified, caused a portion of the displaced material to reach the plaintiff’s boundary. The court’s conviction arises from an assessment of the evidence as a whole, including not only the assertions contained in the complaint and the response to the allegation, but also a review of the five photographs submitted, the account of the inspection conducted by the Fuerza Pública de Bijagua de Upala, the filing of the environmental complaint, and the corresponding notice issued by the municipality of the canton regarding the absence of permits for the earthworks. All this documentary evidence was supplemented by the statements contained in the testimony received, all of which conclusively establishes that such work was performed and the magnitude of its impact on the northern boundary of the plaintiff’s property. Although the witnesses differ as to the measurements and proportion of soil deposited, they agree that the material crossed that boundary or its demarcation, and all of this is accorded the necessary credibility.” (boldface and underlining not in the original) THE CONCEPT OF AN ACTION FOR RESTORATION OF BOUNDARIES (FORMERLY RESTORATION OF BOUNDARY MARKERS):
As can be seen, this possessory injunction seeks to RESTORE BOUNDARIES or, as it was formerly termed, RESTORE BOUNDARY MARKERS, and its OBJECT is therefore the RESTORATION of the BOUNDARY MARKERS, FENCES, or POSTS that the Defendant HAS MOVED and has thereby caused an ALTERATION OF THE BOUNDARIES between the properties. This is established by our legal scholarship and case law, as explained by Costa Rican legal scholars SERGIO ARTAVIA BARRANTES and CARLOS PICADO VARGAS in their book “NUEVO CÓDIGO PROCESAL CIVIL” (pág. 275).
Referring to this type of possessory injunction, they state, insofar as relevant:
“The action for restoration of boundary markers is a special summary adjudicatory proceeding (proceso de conocimiento sumario), the purpose of which is to restore the boundary markers, fences, or posts that the defendant has moved and thereby caused an alteration of the boundaries between the properties; when the boundary markers have been moved and placed somewhere other than where they belong; or when, in erecting a new fence or wall, it was placed somewhere other than where it belonged. It thus protects possession of real property, whose possessor shall have a principal claim seeking performance of an affirmative obligation (obligación de hacer): restoration of the prior possessory condition by returning the boundary markers or fences delineating the property to their original positions. The claim shall be brought against the person or persons who benefited from the alteration and, where appropriate, against those who materially or intellectually caused it, if the two categories of defendants do not consist of the same person.
Compensation for damages may also be asserted as a secondary claim, imposed according to each defendant’s degree of participation in terms of manifest good faith.” As can be seen, the quoted text identifies three circumstances in which an ACTION FOR RESTORATION OF BOUNDARIES would lie; these are likewise the factual scenarios contemplated in Article 106.4 of the Código Procesal Civil:
Under which of these SCENARIOS does the A QUO place us in the JUDGMENT UNDER APPEAL? In our view, none of them. In support of PROVEN FACT 2), the A QUO stated: “although they differ as to the measurements and proportion of soil deposited, they agree that the material crossed that boundary or its demarcation (...).” It is clear that the ACTION FOR RESTORATION OF BOUNDARIES, formerly the action for restoration of BOUNDARY MARKERS, entails RESTORING THE BOUNDARIES to their original condition in order to protect POSSESSION. For this reason, the new CÓDIGO PROCESAL CIVIL now refers to such actions as POSSESSORY INJUNCTIONS. This is also why this type of PROCEEDING is described as an ACTION FOR RESTORATION, because it seeks the RETURN or RESTORATION of peaceful possession of real property of which a person has been IMPROPERLY DEPRIVED or DISPOSSESSED by a third party.
Was the conduct of my client, [Nombre 002], intended to DEPRIVE or DISPOSSESS the Plaintiff of part of his land, or to ALTER THE BOUNDARIES with the Plaintiff for the benefit of the Defendant’s property? CLEARLY NOT.
With all due respect to the A QUO, we believe that the judgment in favor of the Plaintiff, in the terms stated, EXCEEDS the SCOPE of this type of proceeding, specifically the scope of an ACTION FOR RESTORATION OF BOUNDARIES.
According to the aforementioned legal scholars, the ACT OF INTERFERENCE in an ACTION FOR RESTORATION OF BOUNDARIES is defined by law, under which the ALTERATION OF A BOUNDARY must be treated as a nonconsensual LEGAL ACT (HECHO JURÍDICO). In discussing the act of interference in an action for restoration of boundaries, they further state:
“...Thus, such protection is based on ambulo 296 C.Ci., and presupposes that ‘one of the boundary markers delineating the property has been removed’; Article 300 C.Ci. provides, ‘If the boundary markers have been placed incorrectly, the error shall be corrected’; and, more generally, Article 106.4 NCPC covers situations ‘when the boundaries between properties have been altered.’” At no point, including in the FACTS FOUND PROVEN, does the A QUO identify as a proven premise that my client, [Nombre 002], intended to ALTER THE EXISTING BOUNDARIES with the Plaintiff’s property.
The A QUO is clearly attempting to grant the Plaintiff relief by exceeding the scope of this proceeding.
Let us examine what counsel for the Plaintiff stated, insofar as relevant, at the SINGLE HEARING (AUDIENCIA ÚNICA) scheduled in this matter:
“...what they are saying is exactly what we are seeing: that there is an embankment on the adjoining property, and that the northern boundary of the property cannot be found, is not remembered, on the property of Mr. [Nombre 002]; that environmental complaints are supported by the Ley del Ambiente, because he tells us that we do not have to file a complaint and that any earthworks not approved by SETENA or by the Municipality, through which the natural condition of the land is changed, fail to take into account the impact on surrounding properties; in addition to the environmental problems affecting the topography, because—because the Ley Orgánica del Ambiente says so. We may end up causing even greater damage because—because in the Upala area it rains constantly, and merely changing the natural state of things will cause the water that flows naturally to flow directly onto properties for which no study of how that water was actually supposed to move was performed.
If we look directly at all the photographs submitted in the case file, as well as the photographs submitted by the expert, which are of even higher quality, it can be seen that, in the vegetated area within the natural drainage channels (caños naturales) maintained by the Municipality alongside the properties, given that both properties are located on the national highway; therefore, the Municipality itself tells him to bring the property into alignment in order to determine what happened and why earthworks were performed without consulting the Municipality, because he should have submitted the application before undertaking any work, and WE WOULD NOT BE IN THIS PROCEEDING (...).” If the Plaintiff itself reduces this matter to earthworks and concludes that “WE WOULD NOT BE IN THIS PROCEEDING,” how can the A QUO conclude that this is indeed an ACTION FOR RESTORATION OF BOUNDARIES when the factual prerequisites already identified have not been met?
IMPROPER APPLICATION OF ARTICLE 73 OF THE CÓDIGO PROCESAL CIVIL.
In the present matter, in the ruling issued at 15:32 on 16 de Junio del 2020, the Clarifying Party was ordered to provide a VALUATION OF THE CLAIM because the Plaintiff had omitted it; in compliance with that order, the party states:
"1)- Valuation of the claim due to its omission, pursuant to Article 35.3 of the Code of Civil Procedure (Código Procesal Civil).
As requested, this claim is provisionally valued as follows:
FIRST: At EXACTLY TWENTY-FIVE MILLION TWO HUNDRED FIFTY-TWO THOUSAND COLONES (¢ 25.252.0000,oo).
This amount was spent on:
ƒ) Cost of 24-hour on-site security.
(...)
SECOND: Based on a survey of prices per square meter in the area, the property is valued at THIRTY THOUSAND COLONES PER SQUARE METER; therefore, the value of the 1252 m2 parcel is EXACTLY THIRTY-SEVEN MILLION FIVE HUNDRED SIXTY THOUSAND COLONES (¢37.560.000,oo).
Taking into account the value of the land per square meter and the estimates provided for removal of the material, construction of a retaining wall, and the other costs necessary to remedy the damage.
This claim is PROVISIONALLY valued at EXACTLY SIXTY-TWO MILLION EIGHT HUNDRED TWELVE THOUSAND COLONES (¢62.812.000,00)." Based on the justification given by the Plaintiff, at the SOLE HEARING (AUDIENCIA ÚNICA) held in this matter, the COURT BELOW (A QUO), although it did not state so in the JUDGMENT UNDER APPEAL (SENTENCIA RECURRIDA), established the AMOUNT IN CONTROVERSY (CUANTÍA) in this matter as EXACTLY SIXTY-TWO MILLION EIGHT HUNDRED TWELVE THOUSAND COLONES.
Frankly, members of the TRIBUNAL, it is absolutely evident that my client was left in a state of COMPLETE LACK OF DEFENSE (ABSOLUTA INDEFENSIÓN) in this matter. What type of proceeding did the COURT BELOW believe it was adjudicating when the VALUE OF THE PLAINTIFF'S PROPERTY was included in the valuation or amount in controversy as part of the justification for setting that amount? For earthworks that caused material to fall on the Defendant's fence, this action is valued at SIXTY-TWO MILLION EIGHT HUNDRED TWELVE THOUSAND COLONES, almost TWICE the value of the Plaintiff's property, and NO ONE QUESTIONS THIS. Where is our system headed if any opportunist can find in any factual situation a JUSTIFICATION for UNJUST ENRICHMENT, or, as Article 732.1 of the Code of Civil Procedure states when addressing EXEMPTION: "1) The complaint or counterclaim contains excessive claims. (...)." Article 4 of the same body of law refers to ACCESS TO JUSTICE, not to exploiting JUSTICE for OPPORTUNISTIC AND WHOLLY DISPROPORTIONATE CLAIMS in relation to the alleged facts. Subsection 2 of that same article (art. 4.2) states, insofar as relevant:
"4.2. Duties. The parties and participants shall conduct themselves in accordance with good faith, loyalty, probity, the rational use of the procedural system, the respect owed to the persons involved in the proceedings, and the duty to cooperate with the administration of justice, refraining from all malicious, reckless, negligent, dilatory, disrespectful, or fraudulent conduct. Any act contrary to these duties shall be deemed an abuse of process (abuso procesal) and shall be sanctioned by summary dismissal of the application, without prejudice to any applicable disciplinary, criminal, and civil liability." We are clear, and we have stated throughout this APPEAL (RECURSO DE APELACIÓN), that this claim was filed for purposes other than those protected by the possessory action for restoration of boundary markers (INTERDICTO DE RESTITUCIÓN DE LINDEROS); on the contrary, it is plainly an OPPORTUNISTIC CLAIM that takes advantage of a factual situation that does not fit the PROCEEDING at issue in this matter in order to obtain EXCESSIVE SUMS for DAMAGES AND COSTS, which cannot be justified in any way, but which the judgment under appeal allows on the terms set forth therein.
Based on the foregoing, we believe that this matter falls within the circumstances contemplated by Article 73.1.1 of the Code of Civil Procedure.
LAW:
I base this APPEAL on Articles 67, 41.1.1, 101, 73.2.1, 103.1, 106.4 of the Code of Civil Procedure and Articles 277, 296, 300, 305, 307, 309 of the Civil Code (Código Civil).

After the statutory period to appear (emplazamiento de ley) was granted, the respondent stated its arguments regarding the appeal in the terms shown in the brief added to the electronic case file on 29/10/2021 07:09:05.
Fact 1), deemed proven, is approved. Number 2) is deleted and two facts are added, which shall read: "2. The defendant [Nombre 002] performed earthworks on his property, which caused the boundary line (lindero) to be covered and the fence to be damaged (undisputed fact. See the second fact in the complaint and the response to that same fact. Consequently, the admission of the fact permits it to be deemed true pursuant to Article 42.2 of the Code of Civil Procedure). 3. The defendant consented to (se allanó) the first item of the prayer for relief, insofar as it sought repair of the boundary line and removal of the material from the plaintiff's land (see the answer to the complaint, specifically its discussion of the prayer for relief. This fact can be verified from the defendant's express statement)." The fact deemed unproven is deleted because it is irrelevant to this type of proceeding.
The objections raised by the appellant will now be considered and resolved, with the understanding that the notice of appeal limits this Tribunal's jurisdiction pursuant to Sections 65.5 and 65.6 of the Code of Civil Procedure.
After the customary preamble, the appellant submitted its appeal, which it divided into three grounds of error (agravios). It should be clarified that although the appellant alleged a concurrent nullity (nulidad concomitante), it failed to comply with Article 65.5 in fine, namely, the requirement to state first the procedural grounds (which might warrant annulment) and subsequently the substantive grounds (the possible consequence of which would be reversal of the decision brought on appeal). Accordingly, the grounds of error will be analyzed in the order in which they were raised in the appeal.
The appellant begins this ground of error by arguing that the complaint should have been summarily dismissed because the disturbance of the plaintiff's right of possession is not at issue; rather, the case concerns a claim for damages. It asserted that the trial judge allowed the dispute to turn to matters exceeding the scope of possessory relief (tutela interdictal) and that no intent or purpose to disturb the plaintiff's possession was ever established. It challenged the order requiring the defendant to perform affirmative obligations (obligaciones de hacer) that are improper in a possessory proceeding—specifically, construction of a retaining wall—and argued that the damages awarded in an unliquidated amount were not limited to those arising from the possessory relief. It asserted that these defects render the judgment brought on appeal null and ineffective.
The grounds of error are partially well-founded. Article 37.1 of the Code of Civil Procedure establishes that, in the answer to the complaint, the defendant "shall clearly state its position regarding the relief sought and its valuation, the legal grounds, and the evidence submitted and proposed by the plaintiff." Section 37.2 concerns the procedural stages for raising defenses (excepciones), while Article 37.3 lists the procedural defenses. Consequently, if the appellant believed that the claim did not conform to the procedural avenue selected by the party, it should have timely raised the defense. By failing to do so, it forfeited that opportunity, and its argument is untimely.
Moreover, contrary to the assertions made in the appeal, when answering the complaint the defendant consented to the first item of the claimant's requested relief. Consequently, an early judgment (sentencia anticipada) could properly have been entered as to the accepted claim and immediately enforced pursuant to the second paragraph of Article 39 of the Code of Civil Procedure. Therefore, the dispute concerning the selected procedural avenue, as well as the restoration of the boundary line damaged as a result of the earthworks performed by the defendant, ceased to be material following the defendant's express acceptance, by which it consented to the first request made by the plaintiff.
The appellant is correct, however, that an order requiring construction of a retaining wall is improper in a possessory proceeding. With respect to the possessory action for restoration of boundary markers (interdicto de reposición de linderos), Article 106.4 establishes that, if a judgment granting relief is entered, "the boundary markers shall be ordered restored to their original condition. The expenses entailed by replacement or restoration shall be borne by the person responsible for the alteration or by the person who benefited from it, as the court deems appropriate. If the defendant admits that the alteration occurred but denies having caused it, or if the person who caused it cannot be identified, restoration may be ordered at the expense of the plaintiff and the defendant or defendants, as applicable. If the judgment is not complied with voluntarily, enforcement shall proceed in accordance with the provisions governing judgments requiring performance." It is evident that any obligation other than the one prescribed by law—restoring the boundary markers to their original condition—exceeds the subject matter of the possessory proceeding and must therefore be litigated through another procedural avenue.
Now, although the error is considerable, in the view of this Court of Appeals it is unnecessary to vacate the judgment under appeal, since reversing that portion is sufficient to correct it. For that reason, it is sufficient to partially sustain the ground of appeal and reverse the judgment under appeal insofar as it ordered the defendant “to construct a retaining wall along the boundary of its property, extending across every section altered by the earth fill adjoining the plaintiff’s property; the dimensions shall be determined through technical expert evidence, defining the effect of the earth or the pressure that it may exert, or of any undermining caused by rainwater or stormwater that may flow toward the defendant’s land, in order to determine the appropriate conditions for whether or not a retaining wall should be constructed; as well as any damage sustained by the plaintiff’s property and its quantification, which, if applicable, shall be determined by a civil or structural engineer, who shall specify the conditions of the work to be performed along the boundaries between the parties’ properties in this matter and any soil study that may be required.
The engineer shall also provide the value or total costs of the work to be performed, which, once determined, shall be carried out by the defendant at its own expense. The period within which the work must be completed shall be determined once the aforementioned report has been submitted. If the defendant does not carry out the specified containment work, the plaintiff shall be authorized to perform it at the expense of the unsuccessful party, together with payment for any damages that this may cause. The foregoing shall be determined during the judgment-enforcement stage (ejecución de sentencia).” Lastly, regarding the order to pay damages (daños y perjuicios), Article 106.5 of the Code of Civil Procedure provides:
“In every judgment granting relief in summary possessory proceedings (procesos interdictales), the defendant shall be ordered to pay the damages caused. Their assessment, proof, and collection shall be conducted during enforcement of the judgment, in the same case file.” Two relevant conclusions follow from the provision transcribed above. First, the order to pay the damages caused is mandatory; that is, it is not left to the court’s discretion. Second, the corresponding assessment must be conducted during enforcement of the judgment within the same case file as the summary possessory proceeding (interdicto), which means that the damages claimed must necessarily have a causal connection to the facts that gave rise to the judgment granting the summary possessory claim.
Nevertheless, because the award is unliquidated (condena en abstracto), the availability of any damages that may ultimately be assessed will be debated at that stage and is immaterial at this procedural stage.
First, the appellant quoted Article 106.4 of the Code of Civil Procedure verbatim. Then, after analyzing the facts found proven by the court below (a-quo), it considered them insufficient to support the judgment entered in the case. It argued that none of the factual prerequisites contemplated in Article 106.4 of the Code of Civil Procedure for granting a summary proceeding for restoration of boundaries were established here, namely, the alteration of preexisting boundaries between properties when boundary markers (mojones) have been removed and placed elsewhere, or the construction of a new fence that alters the boundaries. It asserted that the defendant’s acts were not intended to deprive or dispossess the plaintiff, or to alter the boundaries for the benefit of the defendant’s parcel. In short, it denied the existence of an act of interference (acto perturbatorio).
The ground of appeal is without merit. As explained in subsection a) of this Whereas clause (Considerando), the appellant did not timely raise the appropriate procedural defenses and therefore forfeited that opportunity. Moreover, it conceded the first request for relief in the complaint, and thus the arguments raised cannot reopen debate concerning the issue already decided.
Furthermore, Article 28.1 of the Code of Civil Procedure provides that rulings must be consistent with the relief requested, while Article 61.2 clearly states that a judgment may not grant more than was requested or encompass matters other than those pleaded. Accordingly, the complaint and the answer to the complaint establish the boundaries of the dispute and the judgment. It should be noted that the arguments raised are new, since they were not presented when the issues were joined (they were never the subject of debate), which—in any event—precludes any consideration of them, especially at this stage of the proceeding.
As its third and final ground of appeal, the appellant challenged the complaint’s valuation at ¢62.812.000,000 and the establishment of the amount in controversy at that sum during the single hearing. It argued that Article 73.2.1 permits exemption from costs when a complaint includes excessive claims, as occurred—according to the appellant—in this case. It therefore requested exemption from costs.
The challenge is partially sustained. As indicated in subsection a) of this Whereas clause, Article 37.1 of the Code of Civil Procedure provides that, in answering the complaint, the defendant “shall clearly state its position regarding the claim and its valuation, the legal grounds, and the evidence submitted and proposed by the plaintiff” (emphasis not in the original). It follows that if the party did not object to the valuation at the appropriate procedural time and, consequently, the amount in controversy was set at the sum stated by the plaintiff, it is clear that the matter cannot be debated before this Chamber because such debate is procedurally barred (precluida).
Notwithstanding the foregoing, in this particular case the defendant conceded the first claim in the complaint, demonstrating its good faith; moreover, before this Court, its arguments against the relief requested in the second subsection of the prayer for relief—namely, construction of a retaining wall—were successful. Added to this is the fact that the claims numbered three through seven concern procedural matters, while the final claim concerns the ruling on costs, which, needless to say, must be made by the court on its own motion (as required by Article 73.1 of the Code of Civil Procedure), and that the award of damages is mandatory under the express provision of Article 106.5 merely because a judgment granting relief was entered in the summary possessory proceeding. Exemption from costs is therefore warranted in this matter.
As a consequence of the foregoing, the appeal must be partially sustained and the judgment under appeal reversed insofar as it ordered the defendant “to construct a retaining wall along the boundary of its property, extending across every section altered by the earth fill adjoining the plaintiff’s property; the dimensions shall be determined through technical expert evidence, defining the effect of the earth or the pressure that it may exert, or of any undermining caused by rainwater or stormwater that may flow toward the defendant’s land, in order to determine the appropriate conditions for whether or not a retaining wall should be constructed; as well as any damage sustained by the plaintiff’s property and its quantification, which, if applicable, shall be determined by a civil or structural engineer, who shall specify the conditions of the work to be performed along the boundaries between the parties’ properties in this matter and any soil study that may be required.
The engineer shall also provide the value or total costs of the work to be performed, which, once determined, shall be carried out by the defendant at its own expense. The period within which the work must be completed shall be determined once the aforementioned report has been submitted. If the defendant does not carry out the specified containment work, the plaintiff shall be authorized to perform it at the expense of the unsuccessful party, together with payment for any damages that this may cause. The foregoing shall be determined during the judgment-enforcement stage.” Likewise, the trial judgment is reversed insofar as it ordered the plaintiff to pay costs, from which it is hereby exempted.
POR TANTO
In accordance with all the foregoing and the cited legal provisions, with respect to the matters appealed, ruling number 2021000071 issued at 12:21 on 01/10/2021 by the Civil and Labor Court of the Second Judicial Circuit of Alajuela, Upala seat (Civil Matters), IS REVERSED solely insofar as it ordered the defendant “to construct a retaining wall along the boundary of its property, extending across every section altered by the earth fill adjoining the plaintiff’s property; the dimensions shall be determined through technical expert evidence, defining the effect of the earth or the pressure that it may exert, or of any undermining caused by rainwater or stormwater that may flow toward the defendant’s land, in order to determine the appropriate conditions for whether or not a retaining wall should be constructed; as well as any damage sustained by the plaintiff’s property and its quantification, which, if applicable, shall be determined by a civil or structural engineer, who shall specify the conditions of the work to be performed along the boundaries between the parties’ properties in this matter and any soil study that may be required.

[Nombre 002] Resolución número 54-2022 TRIBUNAL DE APELACIÓN CIVIL Y TRABAJO DE GUANACASTE (SEDE LIBERIA) (Materia Civil).- A las catorce horas diez minutos del dieciséis de febrero de dos mil veintidós.- ENCABEZAMIENTO INTERDICTO DE REPOSICIÓN DE LINDEROS que se tramita en el Juzgado Civil y Trabajo del II Circuito Judicial de Alajuela, sede Upala (Materia Civil) con el número de expediente 20-000044-1143-CI, establecido por [Nombre 001] contra [Nombre 002]. Las partes son de calidades y domicilios constantes en autos. Intervinieron el Lic. [Nombre 003], carné de agremiado número [Valor 001], en su condición de abogado director de la parte accionante, así como el Lic. Mauricio Rodríguez Méndez, carné de agremiado número 7.121, en calidad de apoderado especial judicial de la parte demandada.
Redacta el juez Ramos Chavarría, y
CONSIDERANDO
La parte actora interpuso interdicto de amparo de posesión mediante el cual solicitó (se transcribe literalmente):
"PRIMERO: Solicito se devuelva al estado original de las cosas los linderos de mi propiedad previamente establecidos y se construya nuevamente la cerca divisoria que demarca el límite de las propiedades.
SEGUNDO: Solicito se construya un muro de contención en el talud creado por el movimiento de tierra, para poder salvaguardar la integridad del terreno y no causar afectaciones mayores a mí terreno.
TERCERO: Solicito además a su autoridad se nombre un perito del despacho, especialista en daños ambientales y para que este haga las valoraciones pertinentes en la zona y así para poder estimar la cuantía de esta demanda, dado que la misma solo se puede hacer después de una investigación en zona para poder determinar el alcance de la afectación y los costos de la remoción de dicho material.
CUARTO: Solicito a su autoridad que se nombre perito especialista y se realice un peritaje para poder estimar los daños y los perjuicios de los cuales fui víctima por este movimiento de terreno sin autorización. Y se le condene al demandado al pago de dichos daños y perjuicios.
QUINTO: Solicito se una anoten las propiedades del señor [Nombre 002], las cuales aparecen en el registro de la propiedad con número de finca en la provincia de [Nombre 004]: [Valor 002], [Valor 003], [Valor 004], [Valor 005], [Valor 016] [Valor 007],[Valor 008], [Valor 009], [Valor 010], [Valor 011], [Valor 012], [Valor 013], [Valor 014]. Además de esto se anoten todas aquellas cuentas bancarias, depósitos o acciones que se encuentren en el sistema bancario nacional a nombre del señor [Nombre 002], para que estas respondan por los daños y los perjuicios causados a mi propiedad.
SEXTO: Solicito a su autoridad se investiguen la verdad real de los hechos realizados y/o las personas involucradas en dicha afectación.
SEPTIMO: Solicito se declare con lugar el presente interdicto de reposición de linderos.
OCTAVO: Solicito se condene a costas procesales y legales a la parte demandada" (sic).
Mediante memorial agregado al expediente electrónico el 05/08/2020 02:05:30, la parte demandada contestó la acción en su contra. Se allanó expresamente al punto primero de la petitoria y solicitó denegar los restantes extremos solicitados. Solicitó le exonere del pago de costas por cuanto está en completa disposición de reparar los daños ocasionados y litigar de buena fe. Además, solicitó que se condene en cotas al actor.
Ahora bien, el señor Juez del Juzgado Civil y Trabajo del II Circuito Judicial de Alajuela, sede Upala (Materia Civil), Lic. Jainer Alonso Gamboa Muñoz, mediante sentencia número 2021000071 de las 12:21 horas del 01/10/2021, resolvió:
"Por tanto:
Se declara con lugar la demanda Interdictal Posesoria de Reposición de Linderos, presentado por [Nombre 001], contra [Nombre 002]. Se ordena al demandado, la reposición del lindero norte de la propiedad del demandante en procura de su estado original, delimitando la misma con cerca divisoria o de contención entre ese límite. Se le ordena construir un muro de contención en la colindancia de su propiedad, que discurra por todo extremo que presente alteración mediante el relleno de tierra presentado para con la del demandante, las dimensiones deberán ser determinadas mediante prueba técnica pericial, en la que se defina la influencia de tierra o presión que puede ejercer esta u cualquier socavación producto de aguas llovida o pluviales y que puedan discurrir hacia el terreno del demandado, para consigo determinar las condiciones propias de construcción o no de un muro de retención; y los posibles daños que haya tenido el inmueble del demandante y su cuantificación, que de ser así se deberá determinarse por medio de un ingeniero civil, estructural, quien deberá dar las condiciones de la obra a realizar entre la colindancias de las partes de este asunto y posible estudio de suelo que se deba practicar. Además deberá otorgar el valor u costos totales de las obras a ejecutar, las cuales una vez determinadas ejecutará la parte demandada a su costo. El plazo en que deberán ser realizadas las obras, será determinado una vez presentado en informe indicado. De no realizar la parte demandada la obra de contención indicada, quedará autorizado el demandante para realizarla por cuenta del vencido, con la cancelación de los daños y perjuicios que ello pudiere ocasionar. Lo anterior a determinarse en etapa de ejecución de sentencia. Corren por cuenta del demandado los daños y perjuicios ocasionados, los que se determinarán en etapa de ejecución de sentencia. Son las costas personales y procesales, a cargo del vencido" (sic).
El artículo 67.5 de la Ley N° 9.342/2016 Código Procesal Civil establece que "Las sentencias, salvo las dictadas en procesos ordinarios de mayor cuantía, tendrán recurso de apelación". En el caso concreto, se desprende de los autos que la sentencia recurrida fue dictada en un proceso sumario interdictal, motivo por el cual la apelación es procedente.
En segundo lugar, debe establecerse si la inconformidad se planteó dentro del plazo legal que conforme al artículo 67.1, párrafo segundo, del Código Procesal Civil vigente corresponde a cinco días. Debe recordarse que los plazos son comunes, por lo que debe contarse a partir del momento en que todas las partes fueron notificadas (inteligencia de los artículos 10 y 38 de la Ley de Notificaciones Judiciales, N° 8.687/2009). En el caso concreto, las notificaciones fueron transmitidas a todas las partes el día 01/10/2021 por medio de correo electrónico (ver actas de notificación incorporadas al expediente electrónico).
Asimismo, y de conformidad con el ordinal 38 de la Ley N° 8.687/2009, tratándose de medios electrónicos, la persona queda notificada al día hábil siguiente de la transmisión y el plazo empieza a correr a partir del día hábil siguiente a la notificación de todas las partes. En consecuencia, la notificación a todas las partes acaeció el 04/10/2021, por lo que el plazo para apelar corrió del 05/10/2021 al 11/10/2021. Se logra constatar que la parte disconforme presentó su recurso el día 11/10/2021 03:06:02, sea dentro del plazo concedido al efecto.
Finalmente, en su recurso la parte apelante expuso las razones por los cuales considera que la resolución recurrida debe ser variada, por lo que se cumple con los requisitos de admisibilidad establecidos.
La parte demandada se mostró disconforme con el pronunciamiento de primera instancia. Por economía, se procede a transcribir el recurso respectivo:
"El suscrito. LIC. MAURICIO RODRÍGUEZ MÉNDEZ , de calidades conocidas en autos como Apoderado Especial Judicial de la parte Demandada, me presento ante su Autoridad con el debido respeto a manifestar:
RECURSO DE APELACIÓN CON NULIDAD CONCOMITANTE Presento formal RECURSO DE APELACIÓN CON NULIDAD CONCOMITANTE contra la SENTENCIA DE PRIMERA INSTANCIA 2021000071, a las 12:21 horas del 01 de Octubre del 2021,por encontramos disconformes con la misma y con base en lo que de seguido se expone:
AGRAVIOS:
En contra de la resolución recurrida se formulan los siguientes cargos, agravios, reproches y quebrantos por el fondo.
En materia interdictal conforme la relación de los artículos 277,305, 307 del Código Civil, 106 a 108 del Código Procesal Civil, se regula la tutela interdictal. De manera cristalina el cardinal 106 del C.P.C. dispone: "Los interdictos sola procederán respecto de la posesión actual y momentánea de bienes inmuebles. De ninguna manera afectarán las cuestiones de propiedad o de posesión definitiva sobre los cuales no se admitirá discusión alguna... Es decir se protege la "posesión ad interdicta" (Meza, Lázanls, Alvaro . Tratado de la Posesión, 2da edición, Isolma, 2015, páginas 166 y siguientes), sea la posesión actual y momentánea sobre bienes inmuebles. Esta demanda interdictal ha debido ser rechazada de plano sin superar el filtro de la admisibilidad, en tanto, no se trata de un asunto donde se discuta la perturbación sobre el derecho de posesión de la parte actora y los hechos que se alegan en la demanda no son típicos o propios de la tutela interdictal sino que se trataría de un proceso declarativo autónomo de daños y perjuicios que se debe ventilar y dirimir mediante un proceso declarativo (artículo 101 del C.P.C.).
De la lectura de la demanda, en ninguno de los hechos o hitos de la misma, se hace referencia a la realización por parte del accionado ([Nombre 002]) de actos que perturben o lesionen el derecho de posesión del demandante o actor y que pretendan la intención del demandado de despojar al actor de su posesión actual o momentánea. Inclusive la actora no alegó ser poseedora del inmueble ni aportó la prueba respectiva, en tanto, la certificación de propiedad no es medio idóneo o útil para acreditar o demostrar la posesión actual y momentánea.
Conforme al numeral 41.1.1 le incumbe la carga de la prueba a quien formule una pretensión, respecto de los hechos constitutivos de su derecho. Así la cosas, el actor tenía la carga de demostrar: i) la posesión actual y momentánea sobre el inmueble, ii) los actos perturbatorias de esa posesión actual y momentánea imputables o atribuibles al demandado y iii) que esos actos perturbatorios tenían la intención de despojar de la posesión actual y momentánea de la cosa al actor. Esa trilogía de elementos no han sido traídos al proceso ni fueron discutidos en la audiencia única llevada al efecto. El derrotero del proceso interdictal -permitido por el Juzgador- corrió por discusiones que exceden o sobrepasan la tutela interdictal, lo que se discutió en el proceso fue la realización del demandado de unas obras de movimiento de tierras que provocaron que se derribara la cerca o colindancia y cayera algunos escombros o material en el terreno del colindante y actor. No dudamos que se le haya causado algún grado de malestar o inconveniente al accionante, pero resulta evidente que esa conducta o comportamiento no tiene el ánimo o la intención de perturbar la posesión del actor.
La sentencia que se recurre condena ilegítamente ad demandado a realizar obligaciones de hacer que no son propias del proceso interdictal, cuyo límite está definido y determinado a tutelar la posesión actual y momentánea del actor, es decir, el fallo debe versar en relación con acoger una pretensión que impida al demandado ejercer actos perturbatorios que inquieten o lesionen la posesión del accionante e igualmente ordenar conforme al 309 del Código Civil que debe abstenerse en lo sucesivo de realizar esos actos so pena de ser acusado por el delito de desobediencia a la autoridad, igualmente condenará en daños y perjuicios en caso de demostrar los mismos, pero en cuanto a esto último, la sentencia se equivoca palmaria y notoriamente en tanto, concede daños y perjuicios que exceden la competencia funcional del juez en un proceso sumario y que son propias de la materia declarativa. Nuestros Tribunales al respecto han dicho:
"...Es cierto que todos los interdictos permiten el cobro de los daños y perjuicios, según lo establece el articulo 460 del citado cuerpo de leyes. No obstante, hay que entender que esa pretensión dentro de un sumario lo es en su carácter accesorio a lo principal, esto es objeto del debate sea materia interdictal. De lo contrario, los daños y perjuicios emergen como pretensión principal y como tal carece de un trámite específico. Por esa razón entran en vigencia los numerales 287 y 421 ibidem, lo que obliga a la parte interesada a reclamarlas en vía declarativa... ( Voto número 457-L, Tribunal Primero Civil de San José, de las 8:15 horas del 10 de mano de 2000, en igual sentido véase del mismo Tribunal, voto No. 897-M.)
En el presente caso, en la sentencia recurrida se concedieron daños y perjuicios y se establecieron obligaciones a cargo del demandado, con una evidente infracción y vulneración de la ley sustantiva y adjetiva por parte del Tribunal fallador, en tanto, si bien el numeral 106.5 del Código Procesal Civil autoriza la condenatoria en daños y perjuicios, estos solamente se pueden conceder cuando se trata de pretensión accesoria del objeto principal - pretensión principal- que debe ser la tutela interdictal. Es decir, solamente son indemnizables aquellos daños y perjuicios en relación directa e inmediata con los actos de perturbación o lesión posesoria, no así, otros daños y perjuicios por graves o enormes que sean, la parte perjudicada debe acudir al proceso declarativo y ello resulta así en atención a la estructura del proceso sumario donde se ventilan los interdictos (103.1.3 del Código Procesal Civil), que no prevé como posible la discusión de daños y perjuicios en sus 14 incisos, para tal efecto debe acudirse a la vía declarativa, nuestros tribunales han sido contestes y uniformes en esa materia: "III En el escrita de demanda, que se inicia a folio 26, la sociedad actora lo que reclama es que la demandada al momento de preparar el terreno contiguo para construir, destruyó la parte de la tapia existente desde hace varios años.Ese es el objeto del debate y es evidente que dicha pretensión no es propia de un proceso sumario de protección posesoria como los interdictos.
El juego de fotografías que se han apartado a la largo de este proceso demuestra que efectivamente la recurrente construyó un local en el lindero oeste de la propiedad de la actora, y al remover tierra para preparar la construcción dañó la tapia que tenía sobre ese lindero. De acuerdo con el articulo 457 del Código Procesal Civil la naturaleza de la demanda interdictal se reduce a la posibilidad de proteger la posesión real o momentánea, sin que pueda cuestionarse problemas de propiedad o posesión definitiva. La conducta de la demandada podría traducirse en una pretensión de daños y perjuicios en un proceso declarativo (ordinario o abreviado según la cuantía). Es cierto que todos los interdictos permiten el cobro de los daños y perjuicios, según lo establece el artículo 460 del citado cuerpo de leyes No obstante, hay que entender que esa pretensión dentro de un sumario lo es en su carácter accesorio a lo principal, esta es objeto del debate sea materia interdictal.
De lo contrario, los daños y perjuicios emergen como pretensión principal y como tal carece de un trámite específico. Por esa razón entran en vigencia los numerales 287 y 421 ibídem, lo que obliga a la parte interesada a reclamarlos en vía declarativa. La petitoria de folio 29, en realidad lo que pretende es una condena de hacer con daños y perjuicios lo que resulta ajena al sumario. Se pide que la demandada reconstruya bajo la misma forma, los mismos materiales y dimensiones de la tapia destruida. En esas condiciones bien pudo denegarse de plano la demanda por motivos de economía procesal y pecuniaria, tanto las partes... En ese sentido y en un caso similar al que nos ocupa, se resolvió: "la resolución apelada se ajusta a derecho y al mérito del proceso, sin que los agravios esgrimidos por la actora recurrente sean de recibo. De acuerdo con el escrito inicial el cuadro fáctico debatidos se reduce a los trabajos realizados por la demandada en una pared medianera, los cuales consistieron en sobrepasar los límites establecidos levantando el techo de su cocina por encima del techo de la propiedad de la actora.
Para ello, se añade en la demanda, despegó las láminas de zinc y así las dejó. Es indudable que esos hechos no constituyen materia interdictal y por ende por razones de economía procesal no se debe cursar el asunto en vía sumaria interdicial. El Tribunal no cuestiona la posibilidad de inconvenientes productos de los trabajos realizados, pero de ninguna manera conllevan una intención de despojo de la accionada en la posesión de la actora. De existir alguna "perturbación" no lo sería en campo de la protección posesoria sino en otras áreas y las cuales podrian generar daños y perjuicios discutibles en un proceso declarativo... . " (Voto número 457-L, Tribunal Primero Civil de San José, de las 8: 15 horas del 10 de marzo de 2000, en igual sentido véase del mismo Tribunal, voto No. 897-M de las 7:45 horas del 20 de julio de 2001).
El voto No. 1518-E de las 7:35 horas del 18 de diciembre de 2001, dispuso: "...Conforme el artículo 457 del Código Procesal Civil, no se discuten cuestiones de propiedad ni de posesión definitiva. Esa prohibición se justifica porque en esta vía lo que interesa es la protección posesoria, y para ello la actora debe acreditar la simple tenencia o posesión de hecho sobre el terreno en debate. En autos se echa de menos prueba idónea en ese sentido,sin que sea suficiente aportar certificación de propiedad debidamente inscrita ni declaraciones de testigos al respecto. Incluso, en la misma demanda se omite indicar en qué consisten los actos de posesión y la testimonial tampoco hace referencia a ese importante aspecto. Por el contrario, de las probanzas evacuadas se desprende que se trata de una clara discusión sobre la titularidad de una colindancia, esto es, la ubicación específica del lindero.....En esas circunstancias, en recto sentido, no se reclama la protección posesoria sin lo la propiedad sobre una faja de tierra, debate ajeno a la vía sumaria. Se debe acudir al proceso declarativo..." En otra resolución se dispuso:
"...los hechos enlistados son ajenos a la protección posesoria y por su naturaleza podrían calificarse de causas productoras de daños y perjuicios, los cuales deben ser ventilados en un proceso declarativo. En efecto, la construcción del muro que nos ocupa, como se observa del juego de fotoografías y lo reconocen los propios actores, no altera la colindancia ya que se construyó a cierta distancia de las tapias existentes-. Tampoco es posible analizar, como acto perturbatorio, la bondad de su construcción. Ahora bien, es evidente que el muro y su consecuente relleno, por su resultado final, algunas molestias ha provocado en los colindantes actores y es posi8ble que las denunciadas hayan ocurrido en toda su dimensión. No obstante, no son productos de actos que inquieten o manifiesten la intención de despojar a los actores de la posesión de sus inmuebles... Lo mismo ocurre, cuando se construye o repara el inmueble colindante y algunos desechos quedan en el techo y obstruyen canoas. En esa situación fáctica, la presencia de los desechos no es materia para un interdicto, pues como sucede en el ejemplo anterior, no son actos que inquietan la posesión y muchos menos tienen la intención de despojar... TRIBUNAL PRIMERO CIVIL, Voto No. 1681-E de las 7:45 horas del 21 de diciembre de 1994 y del mismo tribunal, voto No. 111 de las 8:35 horas del 25 de enero de 1995.
Por consiguiente, la decisión del Despacho venida en la sentencia recurrida en el sentido de ordenar al demandado a: "...construir un muro de contención den la colindancia de su propiedad que discurra por todo extremo que presente alteración mediante el relleno de tierra presentado para con la demandante, las dimensiones deberán ser determinadas mediante prueba técnica pericial, en la que se defina la influencia de tierra o presión que puede ejercer esta u cualquier socavación producto de aguas llovido o pluviales y que puedan discurrir hacia el terreno del demandado, para determinar las condiciones propias de construcción o no de un muro de retención...", resulta totalmente contraria a derecho y a los precedentes jurisprudenciales citados, es decir, dada la estructura del proceso sumario, su limitación en materia de pruebas, audiencia única y la imposibilidad de llevar adelante un contradictorio pleno, no es posible acoger esa pretensión en un proceso interdictal que tiene finalidades que tanto en doctrina, legislación y jurisprudencia se determinan que son únicamente una discusión sobre la posesión actual y momentánea sobre el bien inmueble.
Evidentemente la sentencia es excesiva y violatoria de lo dispuesto en el articulo 106 del Código Procesal Civil que limita la discusión o contradictorio a la "posesión actual y momentánea de bienes inmuebles. De ninguna manera afectarán las cuestiones de propiedad o propiedad definitiva, sobre las cuales no se admitirá discusión alguna..".
En el subjudice no se discutieron aspectos acerca de la posesión actual o momentánea ni sobre los eventuaales actos perturbatorios o la intención o ánimo del accionado de despojar al actor. Esos aspectos que son los que se pueden discutir en el proceso sumario interdictal están ayunos, el Juzgador permitió que se discutieron aspectos extra o meta interdictales, al analizar la demanda, la prueba ofrecida y la audiencia única, vemos que el asunto versó acerca de los daños y perjuicios que se le pueden haber causado a la parte actora y si estos se demostraron o no con la prueba aportada, ese asunto no se tenia que ventilar en el proceso sumario, por ello, la sentencia debe ser anulada, por infringir normas esenciales del procedimiento, en tanto, mediante un proceso sumario se están ventilando y decidiendo aspectos propios del procedimiento declarativo y precisamente el Codificador procesal estableció procesos y pretensiones que se pueden conocer en los mismos, de manera residual previo el proceso declarativo u ordinario para todos aquellos que no tengan un proceso especial.
El numeral 103.1 del C.P.C. no prevé la discusión sobre daños y perjuicios en el proceso sumario sino que el mismo se debe conocer en el proceso ordinario, por ello, la decisión del Juzgador de conceder extremos que no son propios del proceso interdictal provocan indefectiblemente la NULIDAD E INEFICACIA ABSOLUTA DE LA SENTENCIA, en tanto, el Tribunal de Alzada no podría fallar en única instancia.
También impugnamos la condenatoria de daños y perjuicios en abstracto, sin limitar la misma a la pretensión principal que sería la tutela interdictal y no una acción autónoma de cobro de daños y perjuicios por todo lo expuesto supra y para evitar reiteraciones. Esa condenatoria no es posible, en cuanto, no se discutió en esta vía una tutela interdictal sino que de manera extraña el juzgador de instancia dicta una resolución judicial totalmente carente de base jurídica y fáctica, en tanto, ni siquiera de los hechos planteados (causa petendi) se alegaron actos perturbatorios que tengan el propósito de despejar al actor de su posesión actual o momentánea. En el fallo en la parte considerativa el Juzgado no entra a considerar la posible afectación o lesión a la posesión ad interdicta o actual o momentánea del actor sino que entra como si se tratara de un proceso ordinario a valorar la prueba que se aportó al proceso y de manera inaceptable dicta una sentencia estimatoria acogiendo pretensiones que no son propias del interdicto, entonces, si los daños y perjuicios que se pueden conceder deben ser accesorios, en el presente caso se dictan como principales, en tanto, el objeto principal, la tutela interdictal no fue concedida, por ende, se incurre en el grave vicio de incongruencia del fallo, dado que tiene que haber una relación estrecha entre causa de pedir y pretensión, siendo que en el presente asunto, no hay hechos relativos a la perturbación de la posesión actual y momentánea y la forma o manera en que está siendo perturbada esa posesión y que los mismos tienen propósitos de despojo de la posesión, al no estar relatados y demostrados esos hitos no puede el despacho sin violentar la congruencia conceder pretensiones que no calificarían como accesorias sino como principales, otro motivo para anular el fallo..
II AGRAVIO: (MOTIVO DE REVOCATORIA) Falta de fundamentación e indebida valoración probatoria. El A QUO hace una indebida aplicación del artículo 106.4 del Código Procesal Civil referido al Interdicto de Reposición de Linderos.
"106.4.Reposición de linderos. Procede el interdicto de reposición de linderos cuando se incurra en alteración de límites entre inmuebles El perjudicado deberá dirigir su demanda contra el autor del hecho, contra quien se haya beneficiado de este o contra ambos.
En la sentencia estimatoria se ordenará la restitución de los linderos a su estado original. Los gastos que implique la reposición o restitución correrán por cuenta del responsable de la alteración o de quien se haya beneficiado por esta, según lo estime el tribunal. Si el demandado admitiera la existencia de la alteración, pero negara ser el autor o no se pudiera determinar quién fue el autor, se podrá ordenar la restitución a costa del actor y del demandado o demandados, según corresponda. Si no existiera cumplimiento voluntaria de lo que dispone la sentencia, se procederá según lo dispuesto para condenas de hacer." DE LOS HECHOS PROBADOS POR EL A QUO:
Estimamos que los HECHOS PROBADOS por el A QUO no son suficientes para llegar al tipo de condenatoria que se indica en la SENTENCIA RECURRIDA, por lo siguiente:
Sobre los HECHOS PROBADOS, que son ÚNICAMENTE DOS podemos señalar:
DEL PRIMERO:
Únicamente reconoce la colindancia entre las partes.
DEL SEGUNDO:
En este hecho en lo que interesa se indica:
"2. [Nombre 002] realizó movimientos de tierra en su propiedad por tal acción deslizó una parte de tierra hacia la propiedad del demandante, movimientos de tierra realizados sin permiso municipal (...)." Respecto a este hecho probado el A Quo indica en lo que interesa; "...Existe total aceptación en que el demandado realizó trabajos en su propiedad concernientes a movimientos de tierra, de los cuales aún sin que se precisen las dimensiones de este, ocasionó que una parte de ese movimiento diera en el lindero del demandante, la convicción se genera para el juzgador del análisis en conjunto no sólo de las mismas afirmaciones contenidas en demanda y en el hecho contestado, si no que además de la revisión de las cinco fotografías presentadas, el relato de la inspección que realizada fuerza pública de Bijagua de Upala, y la concreción de la denuncia ambiental y la correspondiente notificación que realiza la municipalidad del cantón sobre la inexistencia de permisos para el movimiento de tierras.
Complementó todas estas pruebas documentales, las afirmaciones contenidas en las testimoniales recabadas, de las cuales todos presentan la contundencia de que si se realizaron ese tipo de trabajos y la magnitud de afectación de estos sobre el lindero norte de la propiedad del demandante aunque difieren en las indicaciones de medidas v proporción de tierra depositada. si concuerdan en que el material llegó a sobrepasar ese lindero o bien su delimitación, todo a lo cual se le da la credibilidad necesaria. " (la negrilla y el subrayado no son del original) DEL CONCEPTO DE INTERDICTO DE REPOSICIÓN DE LINDEROS (ANTES REPOSICIÓN DE MOJONES):
Como puede verse, este Interdicto lo que pretende es REPONER LINDEROS o como antes se señalaba REPONER MOJONES, teniendo entonces como OBJETO la RESTITUCIÓN de los MOJONES, CERCAS, o POSTES, que el Demandado HA CAMBIADO y como consecuencia del cual ha provocado una ALTERACION DE LOS LINDEROS entre los inmuebles. Así lo señala nuestra doctrina y jurisprudencia, según lo indican los tratadistas nacionales SERGIO ARTAVIA BARRANTES y CARLOS PICADO VARGAS, en su libro "NUEVO CÓDIGO PROCESAL CIVIL" (pág. 275) Haciendo relación a este tipo de Interdicto, señalan en lo que interesa:
"El interdicto de reposición de mojones es un proceso de conocimiento sumario, de carácter especial, cuyo objeto es la restitución de los mojones cercas o postes que el demandado ha cambiado y como consecuencia del cual ha provocado una alteración de los linderos entre los inmuebles,o cuando haya corrido los mojones y puestos en otro sitio que no les correspondían, o bien cuando a la hora de realizar una cerca o tapia nueva se hubiera colocado en lugar distinto al que le correspondía y así proteger la posesión realizada sobre un bien inmueble, cuyo detentor tendrá una pretensión principal consistente en el cumplimiento de una obligación de hacer: el restablecimiento de su estado posesorio anterior mediante la recolocación de los mojones o cercas que delimitan su inmueble en su posición original, dirigida contra aquella (s) persona (s) que se haya (n) beneficiado con dicha alteración y eventualmente contra los autores materiales o intelectuales, si ambas sujetos pasivos no corresponden a la misma persona.
Podrá tenerse a la vez como pretensión secundaria el resarcimiento de daños y perjuicios, imponible según el grado de participación de los demandados en términos de evidente buena fe." Como puede verse, hay tres circunstancias en las que estaríamos en presencia de un INTERDICTO DE REPOSICIÓN DE LINDEROS, que se señalan en el texto citado, que a su vez son los supuestos de hecho contemplados en el 106.4 del Código Procesal Civil, que son:
En cual de estos SUPUESTOS nos coloca el A QUO en la SENTENCIA RECURRIDA. A nuestro parecer en ninguno. En su justificación del HECHO PROBADO 2) el A QUO señaló "aunque difieren en las indicaciones de medidas v proporción de tierra depositada, si concuerdan en que el material llegó a sobrepasar ese lindero o bien su delimitación (...)" Estamos claros que el INTERDICTO DE REPOSICIÓN DE LINDEROS anteriormente MOJONES, conlleva la acción de RESTITUIR LOS LINDEROS a su situación original, en aras de proteger la POSESIÓN, por eso ahora se menciona en el nuevo CÓDIGO PROCESAL CIVIL haciendo referencia a los Interdicto como INTERDICTOS POSESORIOS. Por ello también, se habla de que este tipo de PROCESO es un tipo de INTERTICTO DE RESTITUCIÓN, porque lo que se pretende es la DEVOLUCIÓN o RESTITUCIÓN de la posesión pacífica sobre un bien inmueble, del que INDEBIDAMENTE se ha PRIVADO o DESPOJADO por un tercero.
Es acaso la acción de mi representado [Nombre 002] , una acción destinada a PRIVAR o DESPOJAR a la parte Actora de parte de su terreno, o bien, una acción para ALTERAR LOS LIMITES con el Actor en beneficio de la propiedad del Demandado, EVIDENTEMENTE NO.
Con el debido respeto que se merece el A QUO, con la sentencia condenatoria a favor del Actor, en los términos que se indica, la mima consideramos SUPERA los ALCANCES de este tipo de proceso, específicamente los alcances del INTERDICTO DE REPOSICIÓN DE LINDEROS.
Según los tratadistas mencionados el ACTO PERTURBATORIO en el INTERDICTO DE REPOSICIÓN DE LINDEROS, los actor perturbatorios o de despojo están definidos en la ley donde la ALTERACIÓN DEL LINDEROS, debe tomarse como un HECHO JURÍDICO no consentido. Asimismo indican al desarrollar el acto perturbatorio en el interdicto de reposición de linderos, lo siguiente:
".. Así esa protección toma como base el ambulo 296 C.Ci., y presupone que "se ha quitado alguno de los mojones que deslindan su propiedad", el 300 C.Ci. "Si los mojones hubieren sido colocados equivocadamente se rectificará el error" y de manera genérica el 106.4 NCPC contempla "cuando se incurra en alteración de límites entre inmuebles." En ningún momento, ni en los HECHOS PROBADOS, el A QUO, indica como premisa demostrada que mi representado [Nombre 002] haya pretendido ALTERAR LOS LÍMITES existentes con la propiedad del Actor.
Evidentemente el A QUO trata de dar solución a las pretensiones del Actor, saliéndose de los alcances de este proceso.
Veamos, que indica en lo que interesa el Abogado de la parte Actora en la AUDIENCIA ÚNICA fijada en este asunto:
"...lo que ellos dicen es exactamente lo que estamos viendo, que hay un talud en la propiedad que colinda, y que la, el lindero de la propiedad al norte no se encuentra, no se recuerda, en la parte quinta del señor [Nombre 002] , que las denuncias ambientales son avaladas por la Ley del Ambiente, porque él nos dice que no tenemos que hacer denuncia y que cualquier movimiento de tierra no avalado por SETENA o por la Municipalidad donde se cambia el estado natural del terreno, no se tiene consideración de la afectación de los terrenos circundantes; además de los problemas ambientales que recaen en la topografía, porque, porque lo dice la Ley Orgánica del Ambiente. Podemos recaer hacer un daño aún mayor, porque, porque en la zona de Upala llueve en cada momento, al uno simplemente cambiar el estado natural de las cosas, el agua que fluye de manera natural va afluir directamente a los terrenos en los cuales no se hizo ningún tipo de estudio de cómo en verdad tenía que moverse esa agua, directamente si podemos ver todas las todos aportadas en el expediente, también las fotos aportadas por el perito, que tiene una calidad aún mayor, se ve que en área de vegetación dentro de los caños naturales que tenía la Municipalidad al costado, dado que las dos fincas se encuentran sobre la carretera nacional, por lo tanto, la misma Municipalidad le dice a él que se ponga en línea para ver que fue lo que sucedió y porqué se hizo movimiento sin constatar con la Municipalidad porque él tenía que haber hecho la solicitud antes de hacer cualquier movimiento y NO ESTARÍAMOS EN ESTE PROCESO, (...)" Si la misma parte Actora, reduce este asunto a un movimiento de tierra, y concluye que "NO ESTARÍAMOS EN ESTE PROCESO", como el A QUO va a llegar a la conclusión que efectivamente estamos ame un INTERDICTO DE REPOSICIÓN DE LINDEROS, sino se cumple con los presupuestos de hecho ya señalados.
III AGRAVIO. INDEBIDA APLICACIÓN DEL ARTÍCULO 73 DEL CÓDIGO PROCESAL CIVIL.
En el presente asunto, dentro de la resolución de las 15:32 horas del 16 de Junio del 2020, se previene a la parte Aclara hacer ESTIMACIÓN de la Demanda por cuanto es omiso La parte Actora, cumpliendo con dicha prevención señala:
"1)- Estimación de la demanda por cuanto es omiso, de conformidad con el Artículo 35.3del Código Procesal Civil.
De conformidad con lo solicitado se estima de manera provisional la presente demanda de la siguiente manera:
PRIMERO: En VEINTICINCO MILLONES DOSCIENTOS CINCUENTA DOS MIL COLONES EXACTOS (¢ 25.252.0000,oo).
La mismo monto solventado:
ƒ) Costo de vigilancia en sitio 24hrs.
(...)
SEGUNDO: El valor de propiedad mediante sondeo de la zona por metros cuadrado es de TREINTA MIL COLONES POR METRO CUADRADO por lo que el valor del terreno de 1252 m2, es de TREINTA Y SIETE MILLONES QUINIENTOS SESENTA MIL COLONES EXACTOS (¢37.560.000,oo).
Tomando en cuenta el valor de terreno por metro y el costo de la cotizaciones brindadas por la remoción del material y construcción de un muro de contención y demás costos para solventar el daño.
Se estima PROVISIONALMENTE la siguiente demanda en SESENTA Y DOS MILLONES OCHOCIENTOS DOCE MIL COLONES EXACTOS (¢62.812.000,00)".
Bajo la justificación dada por el Actor, en la AUDIENCIA ÚNICA celebrada en este asunto, el A QUO, que no la señala dentro de la SENTENCIA RECURRIDA, deja establecida la CUANTÍA de este asunto en la suma de SESENTA Y DOS MILLONES OCHOCIENTOS DOCE MIL COLONES EXACTOS.
Sinceramente, señores del TRIBUNAL es absolutamente evidente que mi representado quedó en ABSOLUTA INDEFENSIÓN en esta asunto. Que tipo de proceso creía el A QUO que estaba resolviendo, cuando se incluye dentro de la estimación o cuantía el VALOR DE LA PROPIEDAD del ACTOR, como parte de justificación de la fijación de la cuantía. Por un movimiento de tierra, en donde cae material sobre la cerca del Demandado, se estima esta acción en SESENTA Y DOS MILLONES OCHOCIENTOS DOCE MIL COLONES, casi sobre el DOBLE del valor de la propiedad del Actor, y NADIE SE CUESTIONA ESTO. Para donde va nuestro sistema, si cualquier oportunista encuentra en cualquier situación de hecho una JUSTIFICACIÓN para ENRIQUECERSE ILEGÍTIMAMENTE, o como lo dice el articulo 732.1 del Código Procesal Civil al referirse a la EXENCIÓN cuando: 1) La demanda o contrademanda comprenda pretensiones exageradas. (...)". El artículo 4 del mismo cuerpo legal habla del ACCESO A LA JUSTICIA, no de servirse de la JUSTICIA, para DEMANDAS OPORTUNISTAS Y TOTALMENTE DESPROPORCIONALES en relación a los hechos que se alegan. El mismo artículo en su punto 2 (art. 4.2) señala en lo que interesa:
"4.2. Deberes. Las panes y los intervinientes deberán ajustar su conducta a la buena fe, a la lealtad, a la probidad, al uso racional del sistema procesal, al respeto debido de los sujetos procesales, y al deber de cooperación con la administración de justicia, evitando todo comportamiento malicioso, temerario, negligente, dilatorio, irrespetuoso o fraudulento. Cualquier acto contrario a estos deberes será considerado como abuso procesal y será sancionado con el rechazo de plano de la gestión, sin perjuicio de las responsabilidades disciplinarias, penales y civiles que correspondan." Estamos claros, y lo hemos mencionado a lo largo de este RECURSO DE APELACIÓN, esta demanda se hace con fines que no es lo que protege el INTERDICTO DE RESTITUCIÓN DE LINDEROS, al contrario, es evidentemente una DEMANDA OPORTUNISTA, aprovechando una situación de hecho que no se ajusta al PROCESO que se discute en este asumo, para la obtención de SUMAS EXAGERADAS en cuanto a DAÑOS Y COSTAS, no justificables de ninguna manera, pero que la sentencia que se recurre permite en los términos señalados en ella.
Con base en lo anterior, estimamos que en este asunto estamos en el supuesto del artículo 73.1.1 del Código Procesal Civil.
DERECHO:
Fundamento este RECURSO DE APELACIÓN en los artículos 67, 41.1.1, 101, 73.2.1, 103.1, 106.4 del Código Procesal Civil, artículos 277, 296, 300, 305, 307, 309, del Código Civil.
PRUEBA:
Los mismos autos.
PRETENSIÓN:
Solicito en Sentencia se declare:
17 a) Con lugar el presente RECURSO DE APELACIÓN; b) Se REVOQUE la SENTENCIA RECURRIDA declarando SIN LUGAR la presente ACCIÓN INTERDICTAL; c) Se condene en costas a la parte contraria.
NOTIFICACIONES:
Señalo para oír notificaciones en este asunto el fax número [Valor 015], o en su defecto el correo electrónico debidamente autorizado del Lic. Mauricio Rodríguez Méndez, que es [...].
RUEGO RESOLVER DE CONFORMIDAD.-
Liberia, 11 de Octubre del 2021" (sic).
Concedido el emplazamiento de ley, la parte recurrida expresó agravios en los términos visibles en memorial incorporado al expediente electrónico el 29/10/2021 07:09:05.
Se aprueba el hecho tenido por probado enumerado 1). Se elimina el número 2) y se agregan dos hechos que dirán: "2. El demandado [Nombre 002] realizó movimientos de tierra en su propiedad, lo que produjo que el lindero se tapara y la cerca se dañara (hecho no controvertido. Ver hecho segundo del escrito de demanda y contestación a ese mismo hecho. Como consecuencia, la admisión del hecho permite tenerlo por cierto, de conformidad con lo dispuesto en el artículo 42.2 del Código Procesal Civil). 3. La parte demandada se allanó al punto primero de la petitoria, en cuanto a reparar el lindero y remover el material en el terreno del actor (ver contestación de la demanda, específicamente al referirse a la petitoria. Hecho constatable de la expresa manifestación del accionado)".
Se elimina el hecho tenido por indemostrados en razón de ser irrelevante para este tipo de proceso.
A continuación se estudiarán y resolverán los reproches que formula la parte recurrente, en el entendido que el escrito de apelación limita la competencia de este Tribunal, conforme con lo dispuesto en el numeral 65.5 y 65.6 del Código Procesal Civil.
Luego del preámbulo de rigor, la parte recurrente planteó su recurso, el cual dividió en tres agravios. Importa aclarar que se bien la parte recurrente alegó una nulidad concomitante, incumplió con lo dispuesto en el artículo 65.5 in fine , sea la obligatoriedad de expresar, primero, los motivos de orden procesal (que pudieren ameritar la nulidad) y, posteriormente, los de fondo (cuya eventual consecuencia sería la revocatoria del pronunciamiento venido en alzada). Por tal motivo, los agravios se analizarán conforme fueron planteados en el recurso.
La parte recurrente inicia el agravio reclamando que la demanda debió haber sido rechazada de plano, pues no se discute la perturbación del derecho de posesión de la parte actora, sino que se trata de un reclamo de daños y perjuicios. Acusó que la persona juzgadora de instancia permitió que la discusión se dirigiera a cuestiones que exceden la tutela interdictal, además de que en ningún momento se acreditó el ánimo o intención de perturbar la posesión del actor. Cuestionó que se condenara al demandado a realizar obligaciones de hacer, impropias del proceso interdictal (específicamente la construcción de un muro de contención), y que los daños y perjuicios condenados en abstracto no se limitaron a los derivados de la tutela interdictal. Acusó que tales defectos provocan la nulidad e ineficacia de la sentencia venida en alzada.
Los agravios son parcialmente de recibo. El artículo 37.1 del Código Procesal Civil establece que en la contestación de la demanda el accionado "manifestará con claridad su posición en cuanto a la pretensión y su estimación, los fundamentos legales y la prueba presentada y propuesta por el actor". El numeral 37.2 se refiere a los momentos procesales para interponer excepciones, en tanto que el artículo 37.3 enumera las excepciones procesales. Como corolario, si la parte apelante consideró que el reclamo no se adecuaba a la vía elegida por la parte, debió interponer la excepción oportunamente. Al no hacerlo, le precluyó esa posibilidad, siendo su argumento extemporáneo.
A mayor abundamiento, y contrario a lo sostenido en el recurso de apelación, al contestar la demanda la parte accionada se allanó al punto primero de la pretensión del accionante. En consecuencia, bien pudo dictarse sentencia anticipada sobre el extremo aceptado y proceder con su ejecución inmediata, según lo dispuesto en el párrafo segundo del artículo 39 del Código Procesal Civil. Por ende, la discusión acerca de la vía, así como la restitución del lindero dañado como consecuencia de los movimientos de tierra realizados por el accionado carecen de trascendencia tras la expresa aceptación del demandado, quien se allanó a la petición primera planteada por la parte actora.
En lo que sí lleva razón el apelante es en cuanto a que la condena a construir un muro de contención, es impropia de la vía interdictal. En cuanto al interdicto de reposición de linderos, establece el artículo 106.4 que en caso de sentencia estimatoria "se ordenará la restitución de los linderos a su estado original. Los gastos que implique la reposición o restitución correrán por cuenta del responsable de la alteración o de quien se haya beneficiado por esta, según lo estime el tribunal. Si el demandado admitiera la existencia de la alteración, pero negara ser el autor o no se pudiera determinar quién fue el autor, se podrá ordenar la restitución a costa del actor y del demandado o demandados, según corresponda. Si no existiera cumplimiento voluntario de lo que dispone la sentencia, se procederá según lo dispuesto para condenas de hacer".
Resulta evidente que cualquier otra obligación diferente de la determinada por ley (restituir los linderos a su estado original) excede el objeto del proceso interdictal y, por ende, deberá ser discutida en otra vía.
Ahora, si bien el yerro es considerable, en criterio de este Tribunal de Apelaciones resulta innecesario anular la sentencia venida en alzada, pues basta la revocatoria de tal extremo para subsanarla. Por tal motivo, baste acoger parcialmente el agravio y revocar la sentencia de alzada en cuanto le ordenó a la parte demandada "construir un muro de contención en la colindancia de su propiedad, que discurra por todo extremo que presente alteración mediante el relleno de tierra presentado para con la del demandante, las dimensiones deberán ser determinadas mediante prueba técnica pericial, en la que se defina la influencia de tierra o presión que puede ejercer esta u cualquier socavación producto de aguas llovida o pluviales y que puedan discurrir hacia el terreno del demandado, para consigo determinar las condiciones propias de construcción o no de un muro de retención; y los posibles daños que haya tenido el inmueble del demandante y su cuantificación, que de ser así se deberá determinarse por medio de un ingeniero civil, estructural, quien deberá dar las condiciones de la obra a realizar entre la colindancias de las partes de este asunto y posible estudio de suelo que se deba practicar.
Además deberá otorgar el valor u costos totales de las obras a ejecutar, las cuales una vez determinadas ejecutará la parte demandada a su costo. El plazo en que deberán ser realizadas las obras, será determinado una vez presentado en informe indicado. De no realizar la parte demandada la obra de contención indicada, quedará autorizado el demandante para realizarla por cuenta del vencido, con la cancelación de los daños y perjuicios que ello pudiere ocasionar. Lo anterior a determinarse en etapa de ejecución de sentencia".
Por último, en cuanto a la condena al pago de los daños y perjuicios, establece el artículo 106.5 del Código Procesal Civil:
"En toda sentencia estimatoria de procesos interdictales se condenará al demandado al pago de los daños y perjuicios causados. La liquidación, la prueba y el cobro se harán en ejecución de sentencia, en el mismo expediente".
A partir del numeral transcrito, se extraen dos conclusiones relevantes. La primera, que la condena al pago de los daños y perjuicios causados es imperativa, es decir, no queda a discreción del tribunal. La segunda, la liquidación correspondiente deberá hacerse en ejecución de sentencia dentro el mismo expediente del interdicto, lo que implica que los daños y perjuicios que se pretendan deben tener necesariamente un nexo causal con los hechos que dieron origen a la sentencia estimatoria de la demanda interdictal.
No obstante, siendo que la condena es en abstracto, será en aquella etapa que se discuta acerca de la procedencia de los daños y perjuicios que eventualmente se liquiden, careciendo de trascendencia en este estadio procesal.
En primer lugar, la parte recurrente hizo una cita textual del artículo 106.4 del Código Procesal Civil. Luego, tras analizar los hechos tenidos por acreditados por el a-quo, consideró que no eran suficientes para sustentar la sentencia recaída en autos. Sostuvo que en la especie no se verifica ninguno de los presupuestos de hecho contemplados en el artículo 106.4 del Código Procesal Civil para la procedencia del interdicto de reposición de linderos, sean la alteración de límites preexistentes entre inmuebles, cuando los mojones se han arrancado y colocado en otro lugar, o bien, por construcción de una nueva cerca que altera los límites. Reclamó que los actos del demandado no se destinaron a privar o despojar a la parte actora, ni para alterar los límites en beneficio de su fundo. En síntesis, negó la existencia de un acto perturbatorio.
El agravio no es de recibo. Tal como se explicó en el acápite a) del presente Considerando, la parte recurrente no opuso las defensas procesales oportunamente, por lo que le precluyó esa posibilidad. Además, se allanó a la petitoria primera de la demanda, motivo por el cual los argumentos planteados impiden abrir nuevamente el debate sobre el punto decidido.
A mayor abundamiento, el artículo 28.1 del Código Procesal Civil establece que las resoluciones deben ser congruentes con lo solicitado, en tanto que el numeral 61.2 es claro al indicar que la sentencia no puede conceder más de lo pedido ni puede comprender otras cuestiones que las demandadas. En ese orden de ideas, la demanda y la contestación de la demanda fijan los límites del contradictorio y de la sentencia. Cabe advertir que los argumentos planteados resultan novedosos, pues que no fueron planteados al trabarse la litis (nunca fueron objeto de debate), lo que -en todo caso- imposibilita cualquier consideración al respecto, máxime a estas alturas del proceso.
Como tercer y último agravio, reprochó la parte apelante que la demanda fuera estimada en la suma de ¢62.812.000,000 y que en la audiencia única se dejara establecida la cuantía en esa suma. Reprochó que el artículo 73.2.1 permite la exoneración en costas cuando la demanda comprenda pretensiones exageradas, como sucede -a criterio del recurrente-, en este caso. Consecuentemente, solicitó se le exonere en costas.
El reproche se acoge parcialmente. Según se indicó en el acápite a) del Presente Considerando, el artículo 37.1 del Código Procesal Civil establece que en la contestación de la demanda el accionado " manifestará con claridad su posición en cuanto a la pretensión y su estimación, los fundamentos legales y la prueba presentada y propuesta por el actor" (el resaltado no pertenece al original). Como corolario, si la parte no objetó la estimación en el momento procesal oportuno y, como consecuencia, se fijó la cuantía en la suma indicada por la parte accionante, queda claro que no puede ser objeto de debate ante esta Cámara por cuanto dicha discusión se encuentra precluida.
No obstante lo dicho, en el caso concreto la parte demandada se allanó a la pretensión primera del libelo de demanda, lo que demuestra su buena fe, además de que en esta instancia encontraron eco los argumentos en contra de lo solicitado en el acápite segundo de la petitoria, sea la construcción de un muro de contención. Si a ello se suma que las pretensiones enumeradas de la tercera a la séptima son cuestiones procesales y la última se refiere al pronunciamiento sobre las costas, que por demás está decir que debe hacerse de oficio (por así ordenarlo el artículo73.1 del Código Procesal Civil) y la condena al pago de daños y perjuicios es imperativa por disposición expresa del artículo 106.5 por el sólo hecho de haber recaído sentencia estimatoria en el proceso interdictal, se justifica la exoneración en costas en el presente asunto.
Corolario de lo dicho, procede acoger parcialmente el recurso de apelación interpuesto y revocar la sentencia venida en alzada en cuanto le ordenó a la parte demandada "construir un muro de contención en la colindancia de su propiedad, que discurra por todo extremo que presente alteración mediante el relleno de tierra presentado para con la del demandante, las dimensiones deberán ser determinadas mediante prueba técnica pericial, en la que se defina la influencia de tierra o presión que puede ejercer esta u cualquier socavación producto de aguas llovida o pluviales y que puedan discurrir hacia el terreno del demandado, para consigo determinar las condiciones propias de construcción o no de un muro de retención; y los posibles daños que haya tenido el inmueble del demandante y su cuantificación, que de ser así se deberá determinarse por medio de un ingeniero civil, estructural, quien deberá dar las condiciones de la obra a realizar entre la colindancias de las partes de este asunto y posible estudio de suelo que se deba practicar.
Además deberá otorgar el valor u costos totales de las obras a ejecutar, las cuales una vez determinadas ejecutará la parte demandada a su costo. El plazo en que deberán ser realizadas las obras, será determinado una vez presentado en informe indicado. De no realizar la parte demandada la obra de contención indicada, quedará autorizado el demandante para realizarla por cuenta del vencido, con la cancelación de los daños y perjuicios que ello pudiere ocasionar. Lo anterior a determinarse en etapa de ejecución de sentencia". Asimismo, se revoca la sentencia de instancia en cuanto condenó a la parte actora al pago de las costas, condena de la cual se le exime.
POR TANTO
Conforme con todo lo expuesto y citas de ley, en lo que fue objeto de recurso, SE REVOCA la resolución número 2021000071 de las 12:21 horas del 01/10/2021, dictada por el Juzgado Civil y Trabajo del II Circuito Judicial de Alajuela, sede Upala (Materia Civil) únicamente en cuanto le ordenó a la parte demandada "construir un muro de contención en la colindancia de su propiedad, que discurra por todo extremo que presente alteración mediante el relleno de tierra presentado para con la del demandante, las dimensiones deberán ser determinadas mediante prueba técnica pericial, en la que se defina la influencia de tierra o presión que puede ejercer esta u cualquier socavación producto de aguas llovida o pluviales y que puedan discurrir hacia el terreno del demandado, para consigo determinar las condiciones propias de construcción o no de un muro de retención; y los posibles daños que haya tenido el inmueble del demandante y su cuantificación, que de ser así se deberá determinarse por medio de un ingeniero civil, estructural, quien deberá dar las condiciones de la obra a realizar entre la colindancias de las partes de este asunto y posible estudio de suelo que se deba practicar.
