PROCEDURAL BACKGROUND (RESULTANDO)

I.According to the complaint, the plaintiff brought these Proceedings, asserting the following claims: “1. Pursuant to Article 42(a) and (b) of the CPCA, I respectfully request a declaration that the following administrative conduct (conductas administrativas), and all related acts or actions, are inconsistent with the legal system, as well as the annulment of all such acts: a. Commercial License or Permit No. 04-717 and related acts. b. The environmental feasibility approval (Viabilidad Ambiental) granted by Resolution 2191-2013-SETENA to the project named ‘Landslide stabilization through quarry extraction,’ in the name of Hacienda San Rafael H.S.R. S.A., and related acts. c. Resolution R-0832015-MINAE, whereby President of the Republic Luis Guillermo Solís Rivera and Minister of Environment and Energy Patricia Madrigal Cordero granted Hacienda San Rafael H.S.R. S.A. the concession for the extraction of materials, and related acts. 2.

Pursuant to Article 42(c), (d), and (f), and Article 99(c) and (f), of the Ley Orgánica del Ambiente, should the foregoing conduct not be declared null and void, I respectfully request that all such conduct and related acts be revoked due to the breaches of legal and contractual obligations identified in this complaint, and that enforcement of the environmental bond (garantía ambiental) be ordered. 3. Pursuant to Article 42(i) of the CPCA, I respectfully request that the Public Administration be ordered to refrain from adopting or carrying out any conduct intended to revive this concession without first obtaining the corresponding technical studies. 4. Pursuant to Article 42(e), (g), and (j) of the CPCA and Article 99 of the Ley Orgánica del Ambiente, I respectfully request that the defendants be ordered to demolish and/or remove the works performed, remediate the environmental damage caused, and assume compensatory obligations for the damage caused.

I likewise request that the Municipalidad de la Unión de Tres Ríos be ordered to establish a real-time monitoring system using cameras and rain gauges; monitor, using GPS, movement within the unstable area in the Las Casuelas sector (sic); establish warning systems using sirens and electronic means; clean the watercourse; and conduct a more detailed analysis of ground movement and the various scenarios in the event of a major landslide, including the preparation of vulnerability maps for potential landslides in this sector of Las Cazuelas. 5. Pursuant to Article 193 of the CPCA, I respectfully request that the defendants be ordered to pay the costs of these proceedings, because we have been compelled to litigate this matter in order to annul or revoke the challenged acts. 6. Pursuant to Article 42(f) and (g) of the CPCA, Article 98 of the Ley Orgánica del Ambiente, Article 199 et seq. of the LGAP, and Article 67 et seq. of the Ley Orgánica de la Contraloría General de la República, once this complaint is sustained, we respectfully request that certified copies of the relevant records (testimonios de piezas) be transmitted to Contraloría General de la República so that administrative investigations may be conducted to sanction the officials responsible for the annulments or lapses declared in these proceedings and recover damages from them. 7.

Pursuant to Article 42(f) and (g) of the CPCA, once this complaint is sustained, and if the Court finds that the facts and acts underlying it may constitute an offense of any kind, I respectfully request that certified copies of the relevant records be transmitted to Ministerio Público for proper investigation. ALTERNATIVE RELIEF (PETITORIA SUBSIDIARIA). 1. Pursuant to Article 42(c), (g), and (j) of the CPCA and Article 99 of the Ley Orgánica del Ambiente, if it is not possible to annul or revoke Commercial License or Permit No. 04-717 and related acts, the environmental feasibility approval granted by Resolution 2191-2013-SETENA, and Resolution R-083-2015-MINAE granting the concession, I respectfully request that, before they are implemented, the technical studies required under the CNE recommendation be conducted to ensure that the works performed will not further destabilize the land.

I likewise request that the Municipalidad de la Unión de Tres Ríos be ordered to establish a real-time monitoring system using cameras and rain gauges; monitor, using GPS, movement within the unstable area in the Las Casuelas sector (sic); establish warning systems using sirens and electronic means; clean the watercourse; and conduct a more detailed analysis of ground movement and the various scenarios in the event of a possible major landslide, including the preparation of vulnerability maps for potential landslides in this sector of Las Cazuelas. 2. Pursuant to Article 193 of the CPCA, I respectfully request that the defendants be ordered to pay both categories of costs (ambas costas) of these proceedings, because my client has been compelled to litigate this matter with the objective of to (sic) annul or revoke the acts challenged herein. 3. Pursuant to Article 42(f) and (g) of the CPCA, Article 98 of the Ley Orgánica del Ambiente, Article 199 et seq. of the LGAP, and Article 67 et seq. of the Ley Orgánica de la Contraloría General de la República, upon this complaint being sustained, I respectfully request that certified copies of the relevant records be transmitted to Contraloría General de la República so that administrative investigations may be conducted to sanction the officials responsible for the annulments or lapses declared in these proceedings and recover damages from them. 4.

Pursuant to Article 42(f) and (g) of the CPCA, upon this complaint being sustained, if the Court should find that the facts and acts discussed herein may constitute an offense of any kind, I respectfully request that

II.After service was effected as required by law, the defendants’ representatives opposed the complaint and raised the following defenses: 1) Hacienda San Rafael HSR S.A.: Failure to Exhaust Administrative Remedies (Falta de Agotamiento de la Vía Administrativa), Improper Joinder of Claims (Indebida Acumulación de Pretensiones), Lis Pendens (Litispendencia), Lack of Standing in both an Active and Passive Capacity (Falta de Legitimación tanto Activa como Pasiva), and Failure to State a Legal Right (Falta de Derecho). (Images 264 through 292). 2) Municipalidad de la Unión: Failure to Exhaust Administrative Remedies and, at Trial during its Opening Statement, Lack of a Current Interest (Falta de Interés Actual). III.The Preliminary Hearing in these Proceedings was held on November 29, 2018. (Images 670 through 680 of the court file. Electronic recording of that Hearing).

IV.The Oral and Public Trial was held at 8:30 a.m. on November 24, 2021. At that trial, the parties were granted three business days to address the evidence submitted for further adjudication (prueba para mejor resolver) by both the State and the CNE representative; the evidence admitted at the Preliminary Hearing was received; and, before the close of arguments, the parties were given an opportunity to present their respective closing arguments. V.This Judgment is issued, following deliberation by the members of the Court, within the fifteen-business-day period established in Article 111.1 of the Código Procesal Contencioso Administrativo—this matter having been declared complex—and no grounds capable of invalidating the proceedings have been found. That period must be calculated by excluding the three business days granted to the parties to address the evidence submitted for further adjudication and the days corresponding to the collective year-end closure.

FINDINGS OF LAW (CONSIDERANDO)

I.REGARDING THE EVIDENCE SUBMITTED FOR FURTHER ADJUDICATION.- As is apparent from the record, before the Oral and Public Trial was held, with oral justification provided during that trial, both the State and CNE submitted documentary evidence so that its admissibility as evidence submitted for further adjudication could be assessed. The State’s representative entered the following documents into the record: 1. Report DGM-CRC1-048-2019 dated June 26, 2019, issued by Lic. Esteban Bonilla Elizondo, Geologist and Mining Coordinator for the Central Region of Dirección de Geología y Minas, constituting the Response to ADPb4466-2019. Status report on case file 2754. Hacienda San Rafael H.S.R. S.A., Dirección13110, . 2. Report DGM-CRC1-085-2019 dated December 16, 2019, issued by Lic. Esteban Bonilla Elizondo / Geologist and Mining Coordinator for the Central Region of Dirección de Geología y Minas, addressing complaint SITADA-6353-2016. Case File Area 2754, Dirección13111, San Rafael, La Unión. 3. Report DGM-CRC1-0082020 dated January 28, 2020, issued by Lic. Esteban Bonilla Elizondo / Geologist and Mining Coordinator for the Central Region of Dirección de Geología y Minas, concerning Oversight of Case File 2574, Hacienda San Rafael HSR S.A., Dirección13110, . 4. Report DGMTOP-O-171-2020 dated Dirección13112, issued by Engineer Etelberto Chavarría

Camacho, of Dirección de Geología y Minas, constituting an inspection report at the request of the Procuraduría General de Costa Rica. 5. Technical Report CNE-UIAR-INF-0595-2021 of Dirección13113, issued by M.Sc Julio Edo. Madrigal Mora, Geologist with the Risk Research and Analysis Unit of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, which follows up on the Río Chiquito Landslide and the stabilization and stone-material utilization project by Tajo Hacienda San Rafael; a site visit was conducted with the Comité Municipal de Emergencias -CME- of La Unión in order to ascertain the current status and the actions being implemented as of junio-2021 and in the future. 6. Report DGM-CRC1-103-2021 of Dirección13114, issued by Lic. Esteban Bonilla Elizondo / Geologist, Mining Coordinator for the Central Region of the Dirección de Geología y Minas, concerning Monitoring of expediente 2754.

Response to CNE-UIARINF-0595-2021. Hacienda San Rafael HSR S.A. San Rafael, La Unión. 7. Report DGM-TOPO-361-2021 of 18 de noviembre de 2021, issued by Eng. Etelberto Chavarría Camacho, of the Dirección de Geología y Minas, which is Inspection Report # 16 on landslide monitoring. Expediente 2754 Tajo San Rafael. 8. Copy of the Ministry of Health sanitary operating permit N°CSARS-CU-205-2019 of 29 de marzo de 2019, issued by the Área Rectora de Salud de Curridabat. For its part, the CNE Representation submitted the following to the case file: 1. Technical Report CNE-UIAR-INF-0595-2021 prepared by Geologist Julio Madrigal Mora and addressed to the Municipalidad de la Unión as part of the Commission’s follow-up regarding the active Río Chiquito landslide. 2. Copy of the first-instance Judgment No. 26-2021-IX in expediente 16-005584-1027-CA, which upheld the defense of lack of passive standing (Falta de Legitimación Ad Causam Pasiva) in favor of the CNE.

This Collegiate Body granted the other parties an opportunity to be heard regarding the cited documentation, under the terms provided in section 50.2 of the CPCA, for a period of three business days, with suspension of the deadline for issuance of this Judgment. In view of the applicable rules, the parties were orally informed that this Chamber would rule on the admissibility of those documents in the Judgment. Opinion of this Court. It is well established that this type of evidence (probanzas), even if offered by the parties, is for the Court—in this case—to assess, and the Court has broad discretion to determine whether the evidence is useful and relevant to deciding the merits of the matter before it. In this case, having analyzed the cited documentation, this Judicial Body finds that all of it is connected to the subject matter and purpose of these Proceedings and, to that extent, is relevant, useful, and pertinent. It must therefore be admitted, as is hereby ordered.

II.PROVEN FACTS.- The following facts of importance to the resolution of this dispute are deemed duly established: 1) That, at the beginning of the nineteen-eighties, a major landslide occurred on the right bank of the río Chiquito, precisely in the area corresponding to the concession discussed in subsequent findings of fact; it dammed the river, triggering an avalanche that caused damage to infrastructure in this city and neighboring communities. (Official Letter DGM-DCM-012-2016 of 24 de febrero de 2016, issued by the Mining Oversight Office and appearing at folios 404 and 405 of the municipal administrative file); 2) That, through Report DPM-INF-0852-2011 dated setiembre 2011, prepared by CNE Geologist Julio Eduardo Madrigal Mora, he stated, among other things, the following: “There is unquestionably a need to implement an Early Warning System involving the population of the lower part (sic) of the Río

Chiquito micro-watershed.” (Folios 1 to 3 of the physical administrative file submitted by the Municipalidad);

  • 3)That Certification SINAC-D-ACCVC-0610-2013 of 31 de julio de 2013 stated, as relevant, that: “based on the location recorded in cadastral survey plan number C-4022-1969, owned by QUEBRADOR SAN RAFAEL S.A. under Real Property Folio 3065878-000, it has been determined that this describes land located OUTSIDE ANY PROTECTED WILDLIFE AREA, REGARDLESS OF ITS MANAGEMENT CATEGORY, ADMINISTERED BY THE MINISTERIO DE AMBIENTE, ENERGÍA Y MINAS.” (Folio 15 of the physical administrative file submitted by the Municipalidad.   • 4)That, through Resolution No. 2191-2013SETENA at eight hours fifteen minutes on veintinueve de agosto de dos mil trece, the Secretaría Nacional Ambiental ordered, as relevant: “Project Description: This consists of developing the extraction of materials from a quarry; breccias and lavas will be extracted and processed using primary and secondary crushers and classified using screens. Fragmentation of the material will require the use of explosives. The intent is to supply coarse and fine aggregates for the production of hydraulic-cement and asphalt concrete in the construction industry. The area requested under concession is 19 ha 9050 m2 for a term of 15 years. Accordingly, ENVIRONMENTAL FEASIBILITY (License) is granted to the project, thereby commencing the Environmental Management phase, subject to compliance with the fundamental Environmental Commitment Clause specified in Considerando Tercero above.” (Folios 16 to 18 of the physical administrative file submitted by the Municipalidad. Renato Jiménez Zúñiga, Head of the Departamento de Servicios Técnicos of the Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria -INTA-, and addressed to Nombre110780 in his capacity as legal representative of Hacienda San Rafael HSR S.A., the following was stated, as relevant: “With regard to your request of 20 de enero 2014, I hereby inform you that this Office has reviewed and approved the document entitled ‘DETAILED STUDY OF THE SOILS AND LAND-USE CAPACITY OF THE PROPERTY BELONGING TO HACIENDA SAN RAFAEL HSR S.A.,’ prepared by agricultural engineers ROY McDONALD BOURNE M., MSc., and JORGE ACÓN HO, authorized certifiers of compliant land use (No. 06 and No. 16, respectively ... Accordingly, and in view of the scientific and technical scope of the soil study conducted by engineers McDonald and Acón, and pursuant to Article 66 of Law No. 7779 on Soil Use, Management and Conservation ... this Office considers that, if the Dirección de Geología y Minas of MINAE grants a concession for the extraction of aggregates for a quarry in the studied section (8.43 ha), this will not cause a loss of soil productivity in the canton of La Unión, because the land limitations reliably demonstrated in the research conducted do not permit profitable and competitive agricultural production.” (Images 92 to 93 of the judicial case file. Capitalization and boldface appear in the original. Underlining is ours);
  • 6)That, through Resolution R-0083-2015-MINAE at nine hours forty minutes on veinte de marzo de dos mil quince, signed by the then-President of the Republic, Mr. Luis Guillermo Solís Rivera, and the then Acting Minister of Environment and Energy, Ms. Patricia Madrigal Cordero, a “Concession for the Extraction of Materials from a Quarry” was granted for a term of 15 years in favor of Hacienda San Rafael HSR S.A. (Folios 201 to 205 of the municipal administrative file);
  • 7)That, through the Land-Use Certificate (Constancia de Uso de Suelo), Municipal Location Resolution SSPU-1110-15-8800701 of 13 de agosto de 2015, Architect José Carlos Barrantes Cubillo, in his capacity as Urban Planning Coordinator of the Municipalidad de La Unión, stated: “APPLICANT:

Nombre110780. CADASTRAL SURVEY PLAN: Placa19467. ZONE: FOREST PROTECTION ZONE. USE: INQUIRY. ACTIVITY: INFORMATIONAL. Forest Protection Zone: Purposes. This zone is necessary to contain urban development, and forestry use shall continue therein. 4. Permitted uses: 1. Forestry. 5. (sic) Single-family housing with suburban characteristics; residential complexes and subdivisions (urbanizaciones) of any kind are excluded in all cases. 6. (sic) Nurseries. 4. (sic) Ecotourism areas. Conditional uses. No conditional uses shall be permitted. NOTE: LAND AFFECTED BY A POTENTIAL RIVER-SCOUR RISK AND WITH A HISTORY OF MAJOR LANDSLIDES (REQUEST AN OPINION FROM THE COMISIÓN NACIONAL DE EMERGENCIAS). THE ZONE DOES NOT PERMIT QUARRYING ACTIVITY, PURSUANT TO ARTICLE 11.b. OF THE REGULATIONS OF THE CURRENT ZONING PLAN OF THE CANTON OF LA UNIÓN. A LAND USE IS NEITHER GRANTS A MUNICIPAL PERMIT OR LICENSE" (Images 114 to 115 of the judicial case file);

  • 8)By official letter MLU-AI-552-2015 of October 6, 2015, the Auditor of the Municipalidad de La Unión submitted a series of questions to the Head of the Registro Nacional Minero concerning the concession granted to the co-defendant company. Questions numbers 3, 4, and 5 are relevant to the matter under review, in which she expressly asked: "3. Is it true that the concession issued by MINAE to Hacienda San Rafael H.S.R. Sociedad Anónima includes licenses for excavation, earthworks (movimientos de tierra), the construction of certain works, and terracing, even though Articles 1, 55, and 74 of the Construction Law state that a municipal license is required for all types of construction work? 4. Among the requirements imposed by the Dirección de Geología y Minas of MINAE, pursuant to the Mining Code or other regulations, is duly approved land use (uso de suelo) issued in advance by the municipality concerned required in order to obtain a concession such as the one indicated here, as stipulated by the Urban Planning Law and the municipalities’ authority to plan urban development? 5. Could the granting of a concession by MINAE be deemed to implicitly exempt the concessionaire from obtaining the construction and earthworks licenses required by urban-planning regulations, as well as authorization for any land-use change (cambio de uso de suelo) established by a municipal regulatory plan (plan regulador)?" (Pages 142 to 145 of the municipal administrative case file);
  • 9)In response to the official letter identified in the immediately preceding established fact, the Head of the Registro Nacional Minero, by official letter DGM-RNM-9852015 of November 16, 2015, answered the questions submitted by the Internal Audit Unit of the Municipalidad de La Unión, stating the following with respect to questions 3, 4, and 5: "3. Pursuant to Article 12 of the Mining Code, an extraction concession is a limited real right (derecho real limitado) arising from an administrative and sovereign act of the State, whereby the State, without relinquishing ownership, authorizes natural or legal persons solely to conduct extraction activities at mineral sites or deposits, subject to the conditions and requirements established by this law, its regulations, and other special laws. In other words, the granting of the concession does not exempt the concessionaire from fully complying with all other regulations, procedures, and technical or legal standards in force in the country, which must be satisfied before (sic) other State institutions. Accordingly, the mining concession does not include any construction license or license of (sic) any other kind." 4. The requirements that every party seeking an extraction concession must satisfy pursuant to the Mining Code and its regulations do not include the submission of land-use approval issued by the municipality where the requested area is located. Nevertheless, as indicated in the second point of this official letter, pursuant to Article 25 of the Mining Code and Article 24 of Regulation No. 29300, quarry extraction concessions require approval of a Soil Suitable-Use Study (Estudio de Uso Conforme del Suelo) by the appropriate department of the Ministerio de Agricultura y Ganadería, namely the Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA)." "5. With respect to this question, the statement in point 3 of this official letter is reiterated: the granting of a concession does not exempt the concessionaire from fully complying with all other regulations, procedures, and technical or legal standards in force in the country, which must be satisfied before other State institutions." (Pages 133 to 140 of the municipal administrative case file);
  • 10)By a written submission dated November 16, 2015, whose "Subject.—Land-Use Change. License to Market Materials Extracted from a Quarry. Río Chiquito Landslide" was stated, Mr. Nombre110780, identification card CED87541, in his capacity as the owner on that date of the property registered in the Cartago Registry District under Real Property Folio registration No. Placa19468, cadastral plan Placa19469, petitioned the Concejo Municipal de la Unión as follows: "Based on the factual and legal arguments presented, the studies and technical evidence supporting them, and the urgent and demonstrated need to carry out the described works, I REQUEST that this Municipality modify the LAND USE for my property so as to AUTHORIZE THE MARKETING OF MATERIAL EXTRACTED FROM THE QUARRY, thereby enabling the stabilization of the Río Chiquito landslide to be financed. All of this shall be subject to the parameters, obligations, commitments, and limitations established in Resolution R-0083-2015-MINAE, which is an Extraction Concession for Materials from a Quarry for a term of fifteen years." (Pages 119 to 131 of the municipal administrative case file. The capitalization, boldface, and underlining appear in the original);
  • 11)By official letter No. MLU-DJUR-023-2016, dated January 19, 2016, the Legal Director of the Municipalidad de la Unión, Lic. Rommel Calvo Padilla, addressed the issue of land use with respect to the aforementioned concession, stating—in relevant part—as follows: "(...) The determination of land use falls within urban-planning regulations, such that the permitted use is the use established by each municipality in its current regulatory plan and zoning regulations (reglamento de zonificación), or, in the absence thereof, pursuant to the Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones, where no regulatory plan exists (Article 169 of the Constitution; Ley 4240, sections 15, 16, subsection c); 21, 24, and Transitory Provision II, opinion C-327-2001). It should be added that the Seismic Code contains specific provisions concerning geological-risk zones that municipalities are required to observe. Ley No. 8488 and its Regulations must also be considered as the legal and technical framework for risk prevention, under which the Comisión Nacional de Emergencias holds paramount authority to issue findings on situations of risk, emergency, and imminent danger and therefore may and must establish technical criteria to guide municipal decisions concerning risk areas within land-use planning processes that could impose limitations on private property. (Opinion C-308-2013). Moreover, although, as stated, regulatory plans are binding upon regulated parties and the Administration because they are normative in nature (C-100-1995, C-93-2007, OJ-11-1996, and OJ-42-2005), by reason of their rank as administrative acts of general application (constitutional judgments 6653-2000 and 42522002; legal opinion OJ-011-1996), they may not contravene higher-ranking provisions such as laws or treaties, nor may they alter the designated purpose of public-domain property (bienes demaniales) (OJ-42-2005). Accordingly, in the event of a legal conflict, public officials must apply the higher-ranking rule (Political Constitution, Article 11; Ley 6227, sections 6 and 11). (...) In view of the above-transcribed provisions derived from Ley 8488, which establish that CNE technical reports are binding upon public institutions and especially municipalities, it follows from the cited precedents of the Junta Directiva de la CNE, the Sala Constitucional, and the Procuraduría General de la República that the municipal authorities must, without exception, take action to address the landslide identified on the right bank of Río Chiquito. For these purposes, the quarry extraction concession authorized by MINAE and the Dirección de Geología y Minas should be used to ensure proper slope management and cleaning of the Río Chiquito riverbed. In implementing this conclusion, it must be borne in mind that the land use of the property belonging to Hacienda San Rafael HSR. S.A., as the subject of the materials-extraction concession, is based not only on the concession granted but also, as MSC. Róger Ovares aptly states, on the fact that '... a mining concession with an appropriate extraction program may contribute to mitigating the risks and impacts caused by a landslide....' Based on the foregoing, sufficient regulatory and legal grounds exist for the concessionaire, Hacienda San Rafael HSR S.A., to begin its stone-extraction activities without further challenge, under the Mining Code and Ley de Emergencias 8488. For these purposes, the concessionaire must undertake the appropriate procedures before the Dirección Tributaria to obtain the corresponding commercial license." (Pages 158 to 167 of the municipal administrative case file);
  • 12)By Administrative Resolution No. MLU-PAT-0127-2016 of January 26, 2016, issued by the Dirección de Administración Tributaria and the Coordinación del Departamento de Patentes of the respondent Municipal Administration, Hacienda San Rafael HRS S.A. was granted Municipal License No. 04-0717 for the activity of "QUARRIES." (Images 111 to 112 of the judicial case file).
  • 13)By official letter DGM-RNM473-2016 of November 14, 2016, issued by the Head of the Registro Nacional Minero in response to a question submitted by the co-defendant company Hacienda San Rafael HSR S.A., the following was stated in relevant part: "The question specifically concerns whether a Health Operating Permit (Permiso Sanitario de Funcionamiento) is required for the extraction of materials from a quarry in order to exercise the right granted by the Executive Branch (sic) to the concessionaire under mining case file No. 2754. (...) The general principle of the prohibition against singular derogation from regulations (inderogabilidad singular de la norma), a general principle of constitutional rank, applies to the entire legal system as both a consequence and a condition of the rule of law in its entirety. (...) Accordingly, it must be noted that conducting extraction activities under a concession requires, among other things (sic), for example, a commercial license if the activity is undertaken for commercial purposes; conducting the activity requires employees to perform various tasks, and those employees must receive the social protections established (sic) under the social-security system; likewise, the provisions of the Ministerio de Salud must be complied with, since national regulations include Decreto No. 34728- S, which is the “GENERAL REGULATIONS FOR THE GRANTING OF OPERATING PERMITS (permisos de funcionamiento) BY THE MINISTERIO DE SALUD,” in the “Risk Group A” category, includes, in the classification table of establishments and activities regulated by the Ministerio de Salud according to Environmental Health Risk, under category C: Mining and Quarrying, in Division 14, Other Mining and Quarrying, group 141, item 1410, “EXTRACTION OF STONE, SAND, AND CLAY (QUARRIES)... In light of the foregoing, it must be concluded that, for the effective exercise of the concession right (derecho de concesión) granted by the Poder Ejecutivo, compliance with the regulations established in the Código de Minería and its Regulations is not sufficient; the provisions of other special laws must also be observed, and such provisions cannot be individually repealed for a particular case.” (Pages 394 to 395 of the municipal administrative record (expediente administrativo municipal));
  • 14)Whereas, by official letter MLU-DJUR-480-2017 dated 5 de junio de 2017, the Legal Director of the Municipalidad de la Unión, Lic. Rommel Calvo Padilla, informed the Municipal Mayor, in relevant part, as follows: “In its final decision issued at 15 horas del 21 de abril del 2017, the Court... ordered: (...) the appeal (recurso de apelación) is manifestly untimely, having been filed only on 28 de marzo de 2016; this requires its dismissal, as declared by the municipal authority in the challenged decision, MLU-DAM-DJUR-2922016 ... Por tanto The decision issued by the Alcaldía Municipal de la Unión in Resolution No. MLU-DAM-DJUR-292-2016 at 9:00 horas del 26 de mayo de 2016 is affirmed, and the administrative remedies (vía administrativa) concerning the matter decided therein are deemed exhausted.” This judicial decision demonstrates that the actions taken and the decision issued by the Municipalidad in connection with the Issuance (sic) of the business license (licencia comercial) complied with the legal system.” (Pages 453 to 454 of the municipal administrative record. Boldface and capitalization appear in the original);
  • 15)Whereas the company Hacienda San Rafael HSR S.A., legal entity identification number (cédula jurídica) CED87539, owns the property registered in Cartago, under Real Property Folio registration (matrícula de Folio Real) No. Placa19470, with cadastral survey plan (plano catastrado) C-4022-1969. (Pages 176 to 177 of the municipal administrative record).

III.POSITION OF THE PARTIES.- In summary, and without prejudice to the literal wording of their arguments, which have been examined in their entirety by this Court, each of the parties alleges what is set forth below in this section. PLAINTIFF ASSOCIATION: That on 14 de mayo del 2003, the Land-Use Plan (Plan Regulador) of the Municipalidad de la Unión de Tres Ríos was published in La Gaceta No. 91, establishing the area where property Matrícula de Folio Real No. Placa19470, owned by Hacienda San Rafael H.S.R. S.A., is located as a forest protection zone (zona de protección forestal). Only forestry uses, single-family housing, nurseries, and ecotourism areas are permitted in that zone. Conditional uses, much less quarry (cantera) operations, are not permitted. That on 28 de enero de 2011, the legal representatives and general attorneys-in-fact of Hacienda San Rafael S.R.L. Sociedad Anónima, legal entity identification number CED87539, applied to the National Mining Registry of the Directorate of Geology and Mines for a temporary reserve for a project to extract materials from a quarry on this property registered in the Province of Cartago under registration number Placa19470 and described in cadastral survey map (plano catastrado) number Placa19471, for the extraction of breccias and lava and the production of crushed stone and sand to obtain coarse aggregates for concrete.

That on 11 de mayo de 2011, Hacienda San Rafael S.A. submitted the form for approval of the project entitled “Extraction of Materials from a Watershed,” which was assigned administrative case file number D1-1573-2011-SETENA and omitted article 11 of the Land-Use Plan of the Municipalidad de la Unión de Tres Ríos from the applicable regulations. That on 5 de setiembre de 2011, geologist Julio Madrigal Mora of the Comisión Nacional de Emergencia issued report DPM-INF-0852-2011, prepared to obtain a technical assessment of the degree of vulnerability posed by the landslide located on the right bank of the río Chiquito; the threats were precisely described and the appropriate recommendations were issued. That on 21 de diciembre de 2012, consulting firm GEO Tec S.A. submitted the environmental impact study (estudio de impacto ambiental) for administrative case file 1573-2011-SETENA to the Service Platform of the Municipalidad de la Unión de Tres Ríos and Nombre3456, respectively.

That on 31 de julio del 2013, certification SINAC-D-ACCVC0610-2013 was issued, stating: (...) based on the location recorded in cadastral survey map number C-4022-1969, owned by Quebrador San Rafael S. A. under Folio Real 3-065878-000, it has been determined that the map describes land located outside any protected wilderness area, regardless of the management category administered by the Ministry of the Environment, Energy and MINAE...” That on 29 de agosto del 2013, through resolution 21912013-SETENA, the Plenary Commission resolved to grant environmental approval (Viabilidad Ambiental) to the project entitled “Landslide Stabilization through Quarry Extraction,” in the name of Hacienda San Rafael H.S.R. S.A., such approval being valid for 5 years for commencement of the works and containing the following description: “The project consists of extracting materials from a quarry; breccias and lava will be extracted and processed using primary and secondary crushers and classified using screens.

Fragmentation of the material will require the use of explosives. The purpose is to supply coarse and fine aggregates for the manufacture of hydraulic-cement and asphalt concrete in the construction industry.” That the area requested under concession is 19 ha 9050 m2 for a term of 15 years, thereby changing the objective for which the proceedings were initiated, in light of the form referred to in fact 7, which was submitted for approval of the project entitled “Extraction of Materials from a Watershed.” That on 20 de marzo del 2014, geologist Lilliam Anieia Hernández, Mining Coordinator for the Región Huetar Norte, issued the following recommendations for granting the concession through memorandum DGM-CMRC1 /20/2014: “The application concerns the extraction of lava breccias and brecciated lava to produce construction aggregates and road-base material (lastre). Based on the reported volume of reserves, it is recommended that the concession be granted for 15 years at an annual extraction rate of 143000 m3.” That on 20 de marzo del 2015, through resolution R-083-2015-MINAE, President of the Republic Luis Guillermo Solís Rivera and Minister of Environment and Energy Patricia Madrigal Cordero granted Hacienda San Rafael H.S.R.

S.A. the materials-extraction concession. That on 7 de julio del 2015, through official letter DGM-CMRC 1-61-2015, it was verified that site-preparation work, terrace formation, construction of sedimentation ponds, construction of offices, and preparations for a barrier gate, among other work, were underway. That on 13 de agosto del 2015, land-use certification (Constancia de uso de suelo) SPPU1110-15-8800701 was issued at the request of Nombre110780 for the property identified by cadastral survey map Placa19467; it stated, among other things, that the area is a forest protection zone in which forestry uses, single-family housing, nurseries, and ecotourism areas are permitted. Conditional uses are not permitted, and the document emphasizes that quarry operations are not allowed in this area, pursuant to article 11.b of the Regulations of the Current Land-Use Plan of the Cantón de la Unión de Tres Ríos.

It further states that the property is affected by a potential risk of river scour and has a history of major landslides, and therefore an opinion must be requested from the Comisión Nacional de Emergencias. That on 18 de noviembre del 2015, application No. 8803914 was prepared, through which “HACIENDA SAN RAFAEL H.S.R. SOCIEDAD ANÓNIMA,” legal entity identification number CED87539, formally applied to the aforementioned Municipality for authorization to conduct commercial quarry operations; the application was received by Ms. Angie Vindas, an employee of the Service Platform, who informed the company that it had not provided land-use approval or a health permit. That on 17 de diciembre del 2015, through official letter MLU-PAT-1790-2015 addressed to Ana Gabriela González Quirós, the Business Licensing Department notified her that she was required to provide the land-use approval issued by the Directorate of Urban Development and Control of the Municipalidad de La Unión.

That on 19 de enero del 2016, the Legal Director of the Municipalidad de La Unión de Tres Ríos issued official letter MLU-DJUR-023-2016, stating that: “... there is a sufficient regulatory and legal basis for the concessionaire Hacienda San Rafael H.S.R. S.A. to commence its stone-extraction operations without further objection, pursuant to the Mining Code (Código de Minería) and Ley de Emergencias 8488.” That through official letter MLU-DATSAC-0006-2016, Gerardo Morales Barboza, relying on official letter MLU-DJUR-023-2016, which Lic. Rommel Calvo Padilla had addressed to Licda. Lidia Garita Rodríguez, stated that: “There is a sufficient regulatory and legal basis for the concessionaire Hacienda San Rafael H.S.R. S.A. to commence its stone-extraction operations without further objection, pursuant to the ‘Código de Minería’ and Ley de Emergencias 8488...” That in the aforementioned official letter MLU-DATSAC-0006-2016, the Director of Tax Administration issued the following written order: “Accordingly, following the instructions of the Legal Directorate, you are requested to proceed with granting the Municipal License (Licencia Municipal) to Hacienda San Rafael H.S.R.

Sociedad Anónima, since, upon analysis of the case, it has been determined that municipal land-use approval is not required because the opinion of the Comisión Nacional de Emergencias, as the competent authority whose determinations are mandatory, prevails.” That on 26 de enero del 2016, through official letter MLUPAT-0127- 2016 from the Business Licensing Office of the Municipalidad de la Unión, Gerardo Morales informed HACIENDA SAN RAFAEL H.S.R. S.A that its application for a Municipal License to conduct the commercial operations of TAJO SAN RAFAEL had been approved on 26 de enero del 2016 through the ADMINISTRATIVE DECISION corresponding to Municipal License number 04717. That on 9 de febrero de 2016, the Department of Environmental Auditing and Monitoring of Nombre3456 inspected the project area pursuant to Inspection Record number Dl-1573-2011-SETENA; it determined that the extraction process had not begun, that the project lacked an operating permit from the Ministry of Health, that its environmental bond (garantía ambiental) was current, and that no violations were found.

That on 7 de marzo de 2016, Dra. Elizabeth González Gamboa of the Área Rectora de Salud de la Unión signed official letter CE-ARS-LU-DA- 256-2016, requiring submission of the municipal land-use approval before a health permit could be granted to the concessionaire. That on 11 de mayo de 2016, the Asociación de vecinos de Sierras de la Unión filed with the incumbent Mayor an extraordinary motion for review (recurso extraordinario de revisión) against the decision authorizing business permit or Commercial License N° 04-717, and subsequently filed an appeal with the Tribunal Contencioso Administrativo under case file 16-007057- 1027-CA -3. That on 13 de mayo del 2016, Dra. Elizabeth González Gamboa of the Área Rectora de Salud de la Unión de Tres Ríos signed official letter CE-ARS-LU-RS-PSF-20 16, in which she clarified: “Notwithstanding the foregoing, it must also be noted that the principal activity at the site will be operation of the open-pit quarry (tajo), which to date lacks municipal land-use approval endorsing that activity.

To the contrary, the case file contains municipal land-use approval No. SPPU-1110- 15-8800701 of 13 de agosto del 2015, which states that quarry operations are not permitted in the area. Since it is my duty to comply fully with the General Health Law (Ley General de Salud), articles 298, 299, 300, 301 and 304 of the Ley General de Salud clearly establish that quarry operations are an industrial activity requiring a sanitary operating permit (permiso sanitario de funcionamiento) in order to operate. Because this is an industrial activity involving the operation of machinery, the installation of crushers, and other activities that may degrade environmental quality and threaten residents’ health, the Ministry of Health must authorize operations in advance and subsequently conduct the necessary oversight to ensure that everything proceeds (sic) normally. It is therefore clear that the undersigned cannot authorize the requested operating permit for conducting at the site: ‘Support activities for other mining and quarrying activities,’ when the principal open-pit quarry operation lacks the permits and/or authorizations of the Ministry of Health.” That as of today, the mining project in the Las Cazuelas sector lacks compliant land-use approval (Uso de Suelo Conforme), any permit from the Ministry of Health, and a declaration of National Interest (Conveniencia Nacional).

That as of today, the Municipalidad de la Unión has not installed GPS devices, cameras, or rain gauges to monitor that land. Nor have vulnerability maps been prepared to prevent a potential avalanche caused by blockage of the Río Chiquito originating from a landslide in the Las Cazuelas sector. GROUNDS (GROUNDS FOR NULLITY): I) FAILURE TO RESPECT THE PRINCIPLE PROHIBITING INDIVIDUAL EXEMPTIONS FROM THE

REGULATION. It is clear that, notwithstanding the wording of Article 15 of the Ley de Planificación Urbana, which grants municipalities authority to determine land uses through regulatory plans (planes reguladores) and other regulations within the territory under their jurisdiction, in this case it is the Municipalidad de la Unión de Tres Ríos itself that is disregarding the provisions of Article 11.b of its regulatory plan by granting a business license (patente comercial) for the operation of an open-pit mine or quarry (tajo o cantera) in an area designated exclusively for forest protection, where the only permitted uses are forestry, single-family housing, nurseries, and ecotourism areas, thereby violating the principle prohibiting individual derogation from regulations (principio de inderogabilidad singular del reglamento). II) VIOLATION OF THE PRINCIPLE OF LEGALITY IN THE GRANTING OF THE MUNICIPAL LICENSE.

The officials who authorize or endorse the granting of the business license seek to claim that the municipal land-use designation (Uso de Suelo Municipal) is established by the aforementioned official letter DST-004-14, pursuant to Ley No. 7779, de Uso, Manejo y Conservación de Suelos, which is absurd because, although that law contains the words Use and Soil, it applies to determining land capability from a strictly agricultural perspective and bears no relation whatsoever to the municipal land-use designation. Thus, the attempt to use it as the basis for the municipal authorization underlying the license granted violates Article 28 of the Ley de Planificación Urbana, which literally provides: “It is prohibited to use or dedicate land, buildings, or structures to any use incompatible with the zoning (zonificación) in effect.” III) LACK OF A LEGITIMATE BASIS DUE TO THE ABSENCE OF A LAND-USE CERTIFICATE.

It is invalid to assert that the basis for the act granting the municipal license, as it relates to the municipal land-use designation, is provided by the INTA certification, when the municipal officials themselves know that on 14 de mayo del 2003, the regulatory plan of the Municipalidad de la Unión de Tres Ríos was published in La Gaceta No. 91, and that it established that the area in which property No. 65878, owned by Hacienda San Rafael H.S.R. S.A., is located is designated for forest protection, where the permitted uses are forestry, single-family housing, nurseries, and ecotourism areas. No conditional uses (usos condicionales) are permitted, and quarrying activity is NOT permitted; it is therefore clear that this municipal authorization lacks a legitimate basis under the municipal regulatory plan. IV) VIOLATION OF THE PRINCIPLE OF LEGALITY BY GRANTING THE MUNICIPAL LICENSE WITHOUT HEALTH PERMITS.

The unlawfulness involved in granting Municipal License 04-717 in enero del 2016 is evident, given that by mayo de ese año no health permit had yet been approved, in complete disregard of Article 299 of the Ley General de Salud, which literally provides: “No authority may grant licenses or permits for the operation of industrial establishments without prior operating authorization from the Ministry.” V) VIOLATION OF THE PRINCIPLE OF LEGALITY DUE TO THE CONSTRUCTION OF WORKS WITHOUT PERMITS. On 7 de julio del 2015, official letter DGM-CMRC 1-61-2015 confirmed that site-preparation work, terrace formation, construction of sedimentation basins, construction of offices, provision for a barrier gate, and other work were being carried out. It is striking that, as of junio del 2015, slope-stabilization work, completed roads, and nearly completed offices and bathrooms had already been observed, when Land-Use Certificate (Constancia de Uso de Suelo) SPPU-1110-15-8800701, requested by Nombre110780 for the property identified by registered survey plan (plano catastrado) Placa19467, was not issued until 13 de agosto del 2015.

Accordingly, because the construction permits were not legally valid, Article 18 of the Ley de Construcciones applies, providing: “Anyone who carries out construction or reconstruction without a municipal permit shall, in addition to paying the fine prescribed by the Reglamento de Policía, be required to demolish what was built.” VI) VIOLATION OF THE PRINCIPLE OF LEGALITY IN THE PROCESSING OF ENVIRONMENTAL VIABILITY (viabilidad ambiental). The environmental regulations applicable to this case include the regulatory plan of the respondent Municipalidad, dated 14 de mayo del 2003, which states that the area in which property MATRICULA Placa19472, owned by Hacienda San Rafael H.S.R. S.A., is located is designated for forest protection, where the permitted uses are forestry, single-family housing, nurseries, and ecotourism areas. No conditional uses are permitted, and quarrying activity is NOT permitted.

It is evident that Nombre3456 never considered that the regulatory plan of the respondent Municipalidad did not permit the operation or functioning of a quarry or open-pit mine at that location, and there was a flagrant violation of subsection c) of Article One of the Guía para el llenado del Documento de Evaluación Ambiental D-1, in Anexo 2 of decreto N 32712-MINAE, which states: “The omission of information requested in the form pursuant to Decreto Ejecutivo No. 31849, or the failure to submit any additional item or document required, shall result in the document being deemed incomplete and rejected in its entirety.” VII) VIOLATION OF THE RULES OF SCIENCE AND TECHNICAL PRACTICE AND OF THE PRECAUTIONARY PRINCIPLE (PRINCIPIO PRECAUTORIO) IN THE GRANT OF ENVIRONMENTAL FEASIBILITY (VIABILIDAD AMBIENTAL). That, for the issuance of resolution 21912013-SETENA granting Environmental Feasibility, Nombre3456 should have explained in the resolution how the environmental mitigation measures (medidas de mitigación ambiental) conformed to scientific and technical principles, in order to ensure that the resolution respected the principles of logic and benefit to the community.

In its view, it failed to do so with regard to the risk of increased landslides caused by blasting and steep slopes, as well as dust generation, material transportation, and the use of heavy machinery. VIII) VIOLATION OF THE PRINCIPLE OF CITIZEN PARTICIPATION (PRINCIPIO DE PARTICIPACIÓN CIUDADANA) IN THE ENVIRONMENTAL FEASIBILITY PROCEEDING. That resolution 2191-2013-SETENA, by which Nombre3456 granted Environmental Feasibility to this project, failed to take into account the existence of many communities: a residential development with more than 200 homes, several apartment complexes and condominiums in la Carpintera, and Estancia Antigua, among the nearest, which will be severely affected by operation of the quarry (tajo). That Nombre3456 likewise failed to take into account the community of Yerbabuena, which appears only as a hamlet but now has schools, secondary schools, and a cooperative.

  • IX)MISUSE OF AUTHORITY (DESVIACIÓN DE PODER) IN THE GRANTING OF ENVIRONMENTAL FEASIBILITY AND THE MUNICIPAL LICENSE (LICENCIA MUNICIPAL). That, upon closer examination, it becomes apparent that the area at risk of collapse is the 15-meter-high slope itself, covering an approximate area of 400 meters, whereas the concession (concesión) granted to Hacienda San Rafael H.S.R. S.A. by resolution R-083-2015 authorizes the exploitation of 11 ha 4519 m2 for a term of 15 years. That it is clear that, if the true need for granting the mining concession (concesión minera) were to minimize the risk, a concession would have been granted exclusively to stabilize or eliminate the slope that could collapse, thereby avoiding greater environmental harm; however, it is evident that, by taking advantage of the risk situation and the CNE opinions (dictámenes), they seek to circumvent the regulations established by the Plan Regulador de la Municipalidad de la Unión, which, as stated supra, does not authorize quarrying activities, but rather conservation activities.

It should also be noted that even CNE is uncertain whether the best option is to intervene in the landslide or whether the better alternative is to leave it untouched, since it has not even been provided with studies justifying such intervention. X) NULLITY (NULIDAD) OF THE CONCESSION AND MUNICIPAL BUSINESS LICENSE (PATENTE MUNICIPAL) FOR FAILURE TO RESPECT THE PUBLIC INTEREST (INTERÉS PÚBLICO). That, in this case, we observe with concern how the officials of the defendant Municipalidad, Nombre3456, and the Dirección de Geología y Minas seek to justify a public interest in granting a mining concession based on a risk to the population; yet, when the area at risk of collapse is examined, it is less than one thousand square meters, while that risk is used to grant a concession for an area of 15.519 m2 for the exploitation of material, for a concession term of 15 years. It is therefore more than evident that the concept of imminent risk (riesgo inminente) is ultimately being used in an attempt to circumvent the regulations established by the Plan Regulador de la Municipalidad de la Unión de Tres Ríos and the Ley Forestal.

It is reiterated that even CNE is uncertain whether the best option is to intervene in the landslide or, conversely, whether the better alternative is to leave it untouched, since, to date, no studies exist that justify such intervention. XI) VIOLATION OF THE PRINCIPLES OF REASONABLENESS AND PROPORTIONALITY (PRINCIPIO DE RAZONABILIDAD Y PROPORCIONALIDAD). That this complaint reiterates the attempt by the defendant Municipalidad, Nombre3456, and the Dirección de Geología y Minas to make it appear that the landslide problem in the Las Cazuelas sector will be resolved by granting a mining concession covering an area of 15.519 m2 for a term of 15 years; however, the area at risk of collapse is less than one thousand square meters. It is therefore evident that the proposed measure is neither proportionate nor rational, particularly considering that this concession is used to justify the violation of the Plan Regulador de la Municipalidad de la Unión de Tres Ríos, since quarries are not authorized as permitted uses at that location under that Municipalidad’s current Plan Regulador.

Furthermore, it is unclear how, in a situation of imminent risk in which intervention should occur as quickly as possible, a concession is instead approved for 15 years of exploitation, a term that is absurdly long for addressing a slope at risk of an almost imminent landslide. XII) ABSENCE OF A DECREE OF NATIONAL INTEREST (DECRETO DE CONVENIENCIA NACIONAL) AND LACK OF TREE-FELLING PERMITS (PERMISOS DE TALA). That Article 34 of the Ley Forestal prohibits the cutting or removal of trees in the protection areas (áreas de protección) described in Article 33 of that body of law, except in projects declared by the Poder Ejecutivo to be of national interest. That, although it is clear that this sector is a protection area of the Río Chiquito and contains trees that could fall into the riverbed, it is likewise clear that, in order to cut those trees, the Poder Ejecutivo must issue a decree declaring the project to be of national interest before the felling occurs; this would require serious studies to be conducted beforehand to justify the decree and determine whether it would be preferable to intervene in the sector to prevent a larger collapse or to leave the site undisturbed so as not to further destabilize it and thereby accelerate and magnify the problem.

That, according to the information contained in the Municipalidad’s administrative records (expedientes administrativos), it does not appear that this tree-felling permit was requested. HACIENDA SAN RAFAEL H.S.R. S.A.: I) That, pursuant to Article 11.b of the Plan Regulador, projects located in forest zones are subject to an environmental impact study (estudio de impacto ambiental) for their approval. Accordingly, if the environmental impact study is approved, a violation of the legal system or of the principles governing administrative action cannot be presumed. That the project was in fact granted approval of that environmental impact study by resolution No. 2191-2013-SETENA, at 8:15 on August 29, 2013. II) That, in addition to the fact that no violation of the Principle of Legality (Principio de Legalidad) can be demonstrated, because it is clear that official communications (oficios) No. DGM-RNM-9852015.DST-004-14 and MLU-DIUR-023-2016 establish that the Administration complied with Articles 11 and 16 of the Ley General de la Administración Pública, the fact remains that there can be no nullity for nullity’s sake where no harm or denial of a defense (indefensión) has been proven in this case.

  • III)That, on this same point, the plaintiff contradicts itself because, as it states, official communication DGM-RNM-985-2015 clarifies the internal auditor’s doubts concerning the land-use study (estudio de uso de suelo), which states that it is unnecessary to submit land-use approval from the Municipalidad where the requested area is located, and that only a conforming land-use study (estudio de uso conforme de suelo) from the Instituto Nacional de Innovación y Transferencia Tecnológica Agropecuaria is required; that study was submitted through official communication DST-004-14, and therefore this argument lacks merit. IV) That there is no violation of the principle of legality in this specific case because, although authorization has been granted to conduct the commercial quarrying activity under official communication No. MLU-PAT-0127-2016 and municipal license No. 04-17, to which the plaintiff refers, the fact is that the activity has not been conducted and all activities related to this commercial operation remain suspended pending issuance of the corresponding permit.
  • V)That, with respect to this section, the factual and legal considerations asserted by the plaintiff are insufficient for this court, even if the claim were to succeed, to order the nullification of the administrative acts declaring subjective rights (actos administrativos declaratorios de derechos subjetivos) issued in its favor. VI) That, in this specific case, the project’s Environmental Feasibility was granted by resolution N° 2191-2013-SETENA in accordance with the rules and principles established in Articles 11 and 16 of the Ley General de la Administración Pública, and the plaintiff has failed to refute those feasibility studies from a technical or scientific standpoint or through reasoned argument supported by opinions and studies issued by qualified professionals in the field at issue. That, moreover, as previously explained, it is untrue that the Plan Regulador has been violated in any way.
  • VII)That the plaintiff relies on a series of facts taken out of context, because it fails to establish clearly how the cited elements relate to this specific case. They therefore lack a logical connection, as is made clear by the use of a country such as China as an example, even though it does not have geographical characteristics remotely similar to those of the area in question; it is therefore absurd to assume, per se, that events occurring in certain areas of that Asian country will also occur in our territory. That, as stated, although the plaintiff challenges the Environmental Feasibility granted by SETENA, it does not submit the expert evidence (elementos periciales) necessary to support its position, and it is improper to make assertions that lack the required technical support. VIII) That there are no grounds for claiming that the Environmental Feasibility is null because there was no citizen participation in the proceeding, since, as stated in the claimant’s arguments, Nombre3456 issued a public notice, and the record in which the environmental feasibility report is being processed is public, as provided by law.

At no time was access to that record denied, nor was anyone denied the opportunity to submit observations or defend their rights through legally established means. IX) That those assertions are unsupported value judgments, since no technical or scientific evidence is presented in this specific case to show that the actions taken fail to fulfill their primary purpose. X) That, in report DPM-INF-0852-2011, Geologist Juan Madrigal Mora states that the site visit clearly showed that obstructions could occur in the short term as a result of falling material, potentially causing serious harm to nearby residents and other important structures in the area. That, for its part, the Dirección de Geología y Minas stated in official communication DGM-RNlM-985-2015 that the mining concession could remedy the situation and prevent the consequences of a landslide, thereby preventing blockage of the river.

That it is in view of the foregoing—the danger posed to nearby residents, the consequences that could result from a failure to address it, and the aforementioned legal and technical powers—that the Administration decided to approve the permit in question. XI) That the plaintiff seeks to make us believe that the requirements have not been met and that the term granted for the authorized area fails to satisfy Reasonableness and Proportionality, yet the plaintiff submits no evidence whatsoever in support of its allegations and attaches no document showing that what was granted fails to satisfy the elements of Reasonableness or that those elements are not Proportionate. That, if the Mining Concession was granted, it was based on technical criteria supported by a series of Official Communications stating that it is appropriate, necessary, and proportionate.

  • XII)The plaintiff states that there is no decree declaring national benefit (Decreto de conveniencia nacional), nor is there a tree-felling permit (permiso de tala de árboles); however, it is clear that neither is available because at no time does it intend to engage in tree felling or forest harvesting (aprovechamiento forestal). As stated in Resolution R-083-2015-MINAE, the only work intended to be performed in the area for which the concession (Concesión) was granted would be the extraction of materials from a quarry, consisting of lava breccias and brecciated lava. At no time is there any intention to disturb or fell trees or undertake forest harvesting. For that reason, the claimant’s assertion should not be considered, because it is irrelevant insofar as the activity in question is neither intended nor has been carried out; therefore, the lack of a felling permit and the absence of a National Decree are immaterial to an activity that has not been performed. MUNICIPALIDAD DE LA UNIÓN: After transcribing official communications (oficios) from various institutions, it states that, by way of conclusion, the following should be considered:
  • 1)There is a report by geologist Julio Madrigal Mora, DRM-INF-0852-2011, concerning the imminent danger posed by the landslide over the río Chiquito.
  • 2)Nombre3456 granted its approval through resolution 2191-2013 SETENA.
  • 3)Through resolution DSF004-2014, INTA granted its approval for that activity.
  • 4)Through DGM-RNM-834-2017, the Materials Extraction Concession was granted to Hacienda San Rafael.
  • 5)There is a ruling of the Constitutional Chamber (Sala Constitucional) under Case File: 16-004105-0007- CO.
  • 6)Following that line of reasoning, Judgment No. 10297-2016 of the Constitutional Chamber is also important.
  • 7)Through resolutions MLU-DJUR-023--2016, which issued a legal opinion, and MLU-DA TSAC-00062016, the latter granting approval for the corresponding business license (licencia comercial), Municipalidad de la Unión authorized that activity. STATE: Specifically, with respect to acts of the State, these judicial proceedings seek to annul resolution No. 2191-2013-SETENA, which granted environmental viability (viabilidad ambiental) to the quarry operation project of co-defendant Hacienda San Rafael H.S.R. S.A., and Executive Branch resolution No. R-083-2015-MINAE, which granted it the corresponding concession. The complaint, as pleaded, is inadmissible because it lacks any legal or evidentiary basis. In that regard, the plaintiff displays a lack of knowledge of the regulations applicable to the challenged acts and, consequently, of the powers vested by law in Nombre3456 and the Dirección de Geología y Minas. In this vein, it should be noted, for example, that throughout the complaint no mention is even made of a provision as fundamental to the case at hand as the Código de Minería, whose opening article “declares all mining activity to be of public utility, both exploration and extraction work. The concentration, processing, transformation, and transportation of mineral substances, as well as privately or State-owned land necessary for those purposes, shall have the same status.” Accordingly, the legislature itself considers the extraction of materials, as well as their transportation, including over privately owned land, to be of public utility, thereby making it a lawful activity. For that reason, the Executive Branch does not need to resort to subterfuges—which, according to the plaintiff, would consist of addressing an imminent risk to the population—to justify the public interest inherent in the concession granted to the co-defendant company through resolution No. R-083-2015-MINAE. A review of both administrative case files (expedientes administrativos) shows that, from the outset of the proceeding, Nombre3456 and the Dirección de Geología y Minas understood that the co-defendant company’s application had the manifestly commercial purpose of operating the quarry. This explains the term and area granted under the concession, consistent with the provisions of the Código de Minería—which causes the plaintiff such surprise—not to resolve a specific landslide problem, but to ensure that the concession project would be feasible. This means that neither of those two administrative agencies relied on the concept of imminent risk in an attempt to circumvent the requirements established by the legal system for issuance of the challenged acts, much less attempted to frighten the population for that purpose, as the plaintiff Association recklessly alleges. As demonstrated by the response to the allegations of this action—particularly allegations 11 and 17—Nombre3456 and the Dirección de Geología y Minas faithfully observed the requirements established in the Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA) 31849-MINAE-S-MOPT-MAG-MEIC dated 24 de mayo del 2004, the Código de Minería and its regulations, as well as each stage of the proceeding prescribed by the cited regulations for issuance of the challenged acts. Indeed, the Environmental Impact Study (Estudio de Impacto Ambiental) prepared by the co-defendant company describes the community consultation process, with participation by the Concejo Municipal de La Unión; and, as stated in the response to the ninth allegation of the action, the administrative case file shows that notice of the submission of that study was published in a newspaper of national circulation, together with a description of the concession project at issue, with no indication that the plaintiff or any other interested party expressed opposition within the granted period of 10 days. Likewise, in observance of the principles of publicity and transparency, the proceedings for granting the mining concession (concesión minera), as recorded in expediente No. 2754 and as stated in the response to allegation 17 of the action, included publication in La Gaceta on 6 y 10 de junio del 2014 of a public notice (edicto) announcing the materials-extraction concession project requested by the co-defendant company, and neither the plaintiff Association nor any other interested party filed any objection within the fifteen business days following the final publication. The procedure whose absence the plaintiff alleges is not established as an essential requirement determining the invalidity of the challenged acts. It is reiterated that Nombre3456 does not have jurisdiction to determine whether land use is compliant (uso conforme del suelo) for the conduct of a particular activity because, under article 28 of the Ley de Planificación Urbana (No. 4240), that obligation rests with the corresponding municipality, specifically the territorial entity that is a co-defendant herein. The plaintiff fails to understand the instrumental nature of the environmental license (licencia ambiental), by virtue of which the beneficiary of that act must also fulfill the obligation to obtain all other permits relevant to the conduct of its activity. This can be confirmed by reviewing the definition of Environmental Impact Study provided in article 2° of the Código de Minería and other related regulations—which it cites. It follows from the instrumental nature of the Environmental Viability (License) (Viabilidad (Licencia) Ambiental) granted through the cited resolution 2191-2013-SETENA that the act does not exempt its recipient from obtaining all other permits from the competent authorities required by the legal system in order to conduct quarry operations. Proof of this is that, despite having the environmental license, the co-defendant company has been unable to begin operations because it lacks a health operating permit (permiso sanitario de funcionamiento). Likewise, regarding the concession granted through resolution No. R-083-2015-MINAE, article 12 of the Código de Minería itself cautions as to the limited scope of that authorizing instrument (título habilitante), and the concessionaire must satisfy the remaining requirements established by the legal system before extraction work may begin. Even more significantly, neither article 25 of the Código de Minería (Ley No. 6797 del 4 de octubre de 1982) nor article 24 of its Regulations requires a land-use permit (permiso de uso de suelo) from the corresponding municipality as a prerequisite for granting the mining concession. As stated in the response to allegation 13 of the action, the Compliant Land-Use Study (Estudio de Uso Conforme del Suelo) endorsed by INTA was in fact submitted in expediente No. 2754. Consequently, during the processing of the two challenged acts—those involving the State—there was no omission whatsoever by Nombre3456 or the Dirección de Geología y Minas. The plaintiff challenges strictly technical matters related to the intervention on the right bank of the Río Chiquito and the mitigation measures (medidas de mitigación) approved in the environmental license. It does so, however, based merely on conjecture or speculation without any technical basis whatsoever. In fact, when analyzing the co-defendant company’s application, both SETENA and the Dirección de Geología y Minas gave careful consideration to the high instability of the project area and the existing vulnerability, based on the findings of CNE report No. DPM-INF-0852-2011, which at that time was the most recent technical opinion issued on the matter by that agency; therefore, always from a technical and scientific standpoint, as will be further corroborated by the testimony of official Chavarría Camacho offered in the evidence section, both offices determined that operation of the quarry, while fulfilling the purposes inherent to this type of activity, could serve as a measure to mitigate the risk of damming the río Chiquito and contribute to stabilizing the soil mass. Indeed, the concessionaire’s incentive to operate the quarry commercially was assessed as part of the project’s feasibility, because the concessionaire would thereby finance the channel maintenance and cleaning work at its own expense. Furthermore, there is no contradiction between the findings of that initial CNE report and the granting of the challenged acts. And, as shown in expediente No. 2754 and stated in the response to allegation 25 of this action, there has been effective coordination between officials of CNE and the Dirección de Geología y Minas. Indeed, the aforementioned Directorate has continued its follow-up and monitoring of the concession area to date, as the proposed witness Chavarría Camacho will corroborate.

IV. GROUNDS FOR THE CLAIM AND THEIR ASSESSMENT BY THIS COURT

As may be seen from a simple reading of the complaint and the co-defendants’ answers, the claimant alleges, as part of its theory of the case (Teoría del Caso), the existence of a series of defects in the formal acts being challenged, dividing them into various sections—12, to be exact—which it titles as follows:

  • i)Failure to respect the Principle of Non-Derogability of Regulations in Individual Cases (Principio de Inderogabilidad Singular del Reglamento). ii) Failure to respect the Principle of Legality (Principio de Legalidad) in granting the Municipal Business License (Patente Municipal). iii) Lack of legitimate grounds due to the absence of land-use certification (certificación de uso del suelo). iv) Failure to respect the Principle of Legality by granting the Municipal Business License without health permits. v) Failure to respect the Principle of Legality due to the construction of works without permits. vi) Failure to respect the Principle of Legality in the processing of Environmental Viability (Viabilidad Ambiental). vii) Failure to respect the rules of science and technology and the Precautionary Principle (Principio Precautorio) in granting Environmental Viability. viii) Violation of the Principle of Citizen Participation (Principio de Participación Ciudadana) in the processing of Environmental Viability. ix) The defect of misuse of authority (desviación de poder) in granting Environmental Viability and the Municipal License (Licencia Municipal). x) Nullity of the Concession (Concesión) and the Municipal Business License due to failure to respect the public interest. xi) Violation of the Principle of Reasonableness and Proportionality (Principio de Razonabilidad y Proporcionalidad). xii) Absence of a National Convenience Decree (Decreto de Conveniencia Nacional) and lack of logging permits.

With the claimant’s line of argument concerning the grounds for nullity thus structured, it may be observed with absolute clarity that the first five refer to the actions taken by the Municipality; the sixth, seventh, and eighth are directed at Environmental Viability; the ninth concerns both said Environmental Viability and the Municipal License; the tenth refers to the Concession and the Municipal License; and, lastly, the eleventh and twelfth are directed solely at challenging the Concession. This being so, in order to follow the sequence in which those arguments were developed, this Chamber shall analyze them in accordance with the numbering and subject matter of each, without prejudice to grouping several of them together—when their subject matter so permits—for joint analysis. Having stated the foregoing, as to the actions taken by the respondent Local Government, the first argument concerns the breach of the Principle of Non-Derogability of Rules (Principio de Inderogabilidad de las Normas), which the claimant considers to have been violated because, in its view, the Municipalidad de la Unión declined to apply section 11.b of the Regulatory Plan (Plan Regulador) to this specific case.

Because this issue is central to the case under review and, moreover, appears first in the claimant Association’s line of argument, this Chamber shall address it immediately below, with the understanding that, if this objection is upheld, the effect it would logically have on the challenged municipal actions would make it unnecessary to rule on the other arguments raised against them in the remaining sections. Having clarified the foregoing, with respect to the first violation alleged by the claimant, we must recall what section 13 of the General Law of Public Administration (Ley General de la Administración Pública) expressly provides concerning the Principle in question:

"1. The Administration shall generally be subject to all written and unwritten rules of the administrative legal system, and to the private law applicable on a supplementary basis thereto, without being able to repeal them or decline to apply them in individual cases.

2. The foregoing rule shall also apply to regulations, whether they originate from the same authority or from another competent superior or inferior authority." The provision is absolutely clear: the Public Administration is prohibited from declining to apply, in individual cases—as an expression of the constitutional Principle of Equality (Principio constitucional de Igualdad)—both written and unwritten rules—ALL OF THEM—and it expressly states that this also applies to regulatory provisions. Although it might well be said that the second paragraph was unnecessary because the first left no room for doubt, since it expressly refers to ALL written and unwritten rules, the legislature did not consider it so and decided to eliminate any room for interpretation or discretion. This principle constitutes a supplementary guarantee for citizens, as an extension of the principle of legality (art.11 of the C.P. and 11 of the LGAP), which requires that the Administration may undertake or authorize only those actions previously authorized by law and that, in any event, it may not decline to apply or repeal the legal system generally in an individual case. In this regard, the Sala Constitucional stated in its Judgment No. 398-2005, issued at twelve ten p.m. on the twenty-first of January, two thousand five, that:

"Indeed, the non-derogability of administrative regulations in individual cases arose as a legal doctrine intended to ensure that an administrative rule of general and abstract scope is not subject to exceptions or rendered inapplicable on a case-by-case basis, that is, in particular individual cases, thereby safeguarding the constitutional principle of equality of its addressees—external effects—before that rule (Article 33 of the Constitución Política)." Having stated the foregoing—that is, having established how the aforementioned Principle is regulated and, furthermore, how it must be applied—section 11 of the Plan Regulador del Cantón de la Unión, which the claimant Association considers to have been violated in subsection b), is transcribed below in full:

"Article 11.-Forest Protection Zone:

  • a)Purposes. This zone is necessary to contain urban development, and forestry use shall continue therein.
  • b)Permitted uses:

Forestry Pursuant to Article 48, Chapter I of the Ley Forestal and its Amendments, the following shall apply for the purposes of this Plan:

"Article 48.-Privately owned forestlands and forests included within a forest reserve or protected zone shall be used in accordance with the applicable management plan (plan de manejo). Their owners shall be entitled to the benefits and incentives established by this Law. Likewise, the owners of these lands shall comply with Articles 60 through 65 of Section II, Chapter 1, concerning the use of forest resources (aprovechamiento del recurso forestal) on privately owned lands under the Ley Forestal.

Single-family housing with suburban characteristics; residential complexes and housing developments of any kind are excluded in all cases.

Nurseries Ecotourism zones c) Conditional uses. Conditional uses shall not be permitted.

  • d)Requirements. In the northern (Zurquí) and southern (Carpintera) zones, the requirements of Article 5 of the GAM regulations shall apply.

Minimum area: 10 Ha. in the northern zone beginning at Dirección3536 and 5 Ha. in the southern zone with the same reference.

Minimum lot frontage: 50 meters.

Setbacks Front: 20 meters Side: 5 meters Rear: 5 meters Maximum lot coverage: 10% of the lot.

Maximum floor area: 10% of the lot area.

Projects in this zone are subject to an environmental impact study (estudio de impacto ambiental)." The regulatory provision just transcribed is unequivocal as to the permitted uses: forestry, single-family housing, nurseries, and ecotourism zones. The provision then states that conditional uses are not permitted and that projects—which must be understood to mean permitted projects—shall be subject to an environmental impact study. Express reference is made to projects permitted in that zone because, if the contrary interpretation were adopted—as the respondent company appears to do—namely, that any project may be developed there as long as it has an environmental impact study, the provision under analysis would be rendered meaningless, and both the list of permitted uses and, of course, the prohibition of conditional uses would become absurd. Indeed, under that assumption—that is, as the co-defendant corporation appears to understand it—it would have been sufficient for the section to state that, in addition to the permitted uses, any project having an environmental impact study is permitted in that zone.

Alternatively, the provision could have stated that, in addition to the expressly permitted uses, those outside this exhaustive list that had an environmental impact study would also be deemed permitted—because conditional uses were expressly prohibited. It would then be possible to distinguish between permitted projects that would not require an environmental impact study and those that would also be permitted because they had such a study. That would be a regulatory absurdity in the context of Regulatory Plans, because ultimately it would regulate nothing concerning land use. Anything could be done—that is, developed. Indeed, it should be noted that the respondent Municipality itself understands the matter as this Chamber does, since, when deciding the application for a Land-Use Certificate (Certificado de Uso de Suelo), Architect José Carlos Barrantes Cubillo, in his capacity as Urban Planning Coordinator for the respondent municipal entity, clearly and precisely stated—proven fact No. 7—that:

"APPLICANT: Nombre110780 . CADASTRAL PLAN: Placa19467. ZONE:

FOREST PROTECTION ZONE. USE: INQUIRY. ACTIVITY: INFORMATIONAL.

Forest Protection Zone: Purposes. This zone is necessary to contain urban development, and forestry use shall continue therein. 4. Permitted uses: 1. Forestry. 5. (sic) Single-family housing with suburban characteristics; residential complexes and housing developments of any kind are excluded in all cases. 6. (sic) Nurseries. 4. (sic) Ecotourism zones. Conditional uses. Conditional uses shall not be permitted. NOTE: LAND AFFECTED BY A POTENTIAL RISK OF RIVER UNDERCUTTING AND WITH A HISTORY OF MAJOR LANDSLIDES (REQUEST AN OPINION FROM THE COMISIÓN NACIONAL DE EMERGENCIAS). THE ZONE DOES NOT PERMIT QUARRYING ACTIVITY, PURSUANT TO ARTICLE 11.b. OF THE REGULATIONS OF THE PLAN REGULATORY PLAN (PLAN REGULADOR) IN FORCE FOR THE CANTON OF LA UNIÓN. A LAND-USE DESIGNATION (USO DE SUELO) IS NOT, NOR DOES IT GRANT, A MUNICIPAL PERMIT OR LICENSE." In ruling on the aforementioned application, the official left no room for doubt, expressing an expert opinion clearly consistent with the content of the above-cited provision.

Notwithstanding the foregoing, by official letter No. MLU-DJUR-023-2016, dated 19 de enero de 2016, the Legal Director of the Municipalidad de la Unión, Lic. Rommel Calvo Padilla, found that it was not appropriate to require it—meaning the Land-Use Certificate (Certificado de Uso de Suelo)—because of the binding nature of the recommendations issued by the CNE, the Kelsenian pyramid—the hierarchy of laws—the “regulatory nature of Regulatory Plans,” and a series of provisions, including provisions of the Código Sísmico, which he used as the “basis” for his legal opinion. (Proven Fact No. 11). This Chamber disagrees with that opinion, because what the CNE stated was that the area had to be addressed due to the risks of landslides and river damming, but never that a quarry concession (concesión de Cantera) had to be granted or that the Regulatory Plan should not apply in that sector, since such a course of action would plainly be unlawful.

Thus, as confirmed at Trial by the CNE geologist, Mr. Julio Eduardo Delgado Mora, what was deemed urgent was intervention in the area in order to “manage the risk,” which in no way should be understood as carte blanche to disregard compliance with essential requirements such as the Land-Use Certificate in cases like the one before us. Put differently, the situation described by the CNE certainly demonstrated a need for urgent intervention in the area in question, but under those circumstances, what was required was precisely that: for the competent authorities to intervene in the area, not for that situation to be used to issue administrative acts (actos administrativos) intended to enable the co-defendant company to conduct quarrying activities, even though such activities were not permitted under the Regulatory Plan. In other words, the CNE never issued a binding recommendation that a business license (licencia comercial) and a quarry concession be granted, simply because it was legally barred from issuing such recommendations.

In this regard, it bears recalling that the Regulatory Plan, “by reason of its content and its general effectiveness or binding force, must be regarded as comprising true legal rules or laws in the substantive sense, since it recognizes rights and establishes obligations for the owners and possessors of real property located within the territorial jurisdiction of the respective canton” (Sala Constitucional 2006-13330 del 06 de setiembre de 2006); accordingly, although it may be disapplied for emergency reasons, such a circumstance must be supported by the formal existence of an Emergency Decree (Decreto de Emergencia). The latter act, as provided by the Ley Nacional de Emergencias y Prevención del Riesgo, has the legal force to temporarily displace the Principle of Legality (Principio de Legalidad) and replace it with the Principle of Necessity (Principio de Necesidad). Hence, it is used as the classic example of an act having the status or force of law. Along these lines, the aforementioned Law expressly provides as follows in Article 4:

“State of emergency (Estado de emergencia): A declaration by the Executive Branch, issued by means of an executive decree (decreto ejecutivo), based on a state of necessity and urgency caused by circumstances of war, internal unrest, or public calamity. This declaration permits, by way of exception, the management of the actions and allocation of the resources necessary to address the emergency, in accordance with Article 180 of the Constitución Política.” An emergency declaration is so significant that the aforementioned body of law establishes in section 36—among other exceptional measures—that:

“Privately owned properties located within the geographical areas specified in the emergency declaration shall be subject to all easements (servidumbres) necessary to carry out the actions, processes, and works to be undertaken by public entities under the coordination of the Commission. This provision must be expressly included in the emergency decree. Likewise, owners shall be required to permit the temporary occupation (ocupación temporal) of their properties when absolutely indispensable to address the emergency in a timely manner. Temporary occupation shall be limited to the space and time strictly necessary, which must correspond to the phase contemplated in subsection a) of Article 30 of this Law. Every effort shall be made to cause the least possible harm; nevertheless, damages caused during such occupation may be compensated upon application by a party, provided that a judicial expert appraisal has been conducted.

By means of a reasoned and binding decision, the Commission may order the demolition of any public or private building located within the geographical areas included in the emergency declaration when, because it is ruined or deteriorated, or because it is located in an area of imminent danger, it endangers the safety or health of residents or other persons, all in accordance with technical studies recommending such action. This decision shall give rise to no compensation whatsoever, and only a motion for reconsideration (recurso de reposición) may be filed against it.” The situation described by the aforementioned provisions demonstrates the exceptional circumstances under which this form of displacement of the Principle of Legality by the Principle of Necessity occurs, requiring for that purpose the existence of formal governmental action—an act having the status of Law—which is nothing more than the Decree declaring the State of Emergency (Estado de Emergencia)—which clearly did not occur in the case under review.

Put differently, that temporary suspension of ordinary procedures, or of the Principle of Legality (Principio de Legalidad), is legally possible only when such a declaration exists, and an opinion, recommendation, or report from the CNE, no matter how binding it may be—section 14.c of the aforementioned Law—can never have such legal force. Therefore, on the basis of such recommendations, reports, and/or opinions, it is not legally permissible to decline to apply the Regulatory Plan (Plan Regulador) in a specific case. It is likewise important to clarify that, although the respondent Municipality expressly refers to a soil study approved by the INTA—Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria—it does not provide any substantive argument explaining why it considers that a study endorsed or approved by that maximally decentralized body with instrumental legal personality, attached to the Ministerio de Agricultura y Ganadería, can “update” the land use (uso de suelo) established in the Regulatory Plan, disregarding the provisions of the Ley de Planificación Urbana.

This Chamber understands that there are situations in which following a particular procedural channel (cauce procedimental) is not necessarily the most expeditious course. Nevertheless, the legislature provided not only for such channels but also for exceptions to their application, and it cannot be asserted that the present case involves such an exception—a Declaration of a State of Emergency (Declaratoria de Estado de Emergencia). Thus, if there is a need to “update” a Regulatory Plan, that task cannot be carried out through a study performed, approved, endorsed, or validated by the INTA, but rather through the mechanism established in the Ley de Planificación Urbana. Moreover, as stated above, the Municipality presented absolutely no argument on this issue that would permit further examination, as it did not even explain why, in its view, the “indirect method of updating” used in the case under review was permissible.

This was unquestionably of the utmost importance, considering that the INTA, pursuant to section 2 of its enabling Law, was conceived with the objective of “contributing to the improvement and sustainability of the agricultural sector through the generation, innovation, validation, research, and dissemination of technology for the benefit of Costa Rican society.” It was authorized to “sell agricultural research services, provided that doing so does not impair its response to demands for research of social interest.” It was also required to promote and conduct “research related to organic agricultural production...” and to facilitate “the transfer of technology among producers.” Put differently, the respondent municipal entity does not explain how—meaning under which provisions—an Institute created for the Agricultural Sector can, through a study performed or approved by it, substitute, replace, amend, or “update” the land use established in a Regulatory Plan without following the Procedure set forth in the aforementioned Ley de Planificación Urbana.

Still regarding the Municipality’s conduct, it is entirely inconsistent with reality to assert, as Municipal Legal Director Licenciado Rommel Calvo Padilla did in official letter MLU-DJUR-480-2017 of 5 de junio de 2017 (proven fact No. 14), that, by dismissing as untimely the appeal (recurso de apelación) filed against resolution MLU-DAM-DJUR-292-2016 issued at 9:00 on 26 de mayo de 2016 by the Alcaldía Municipal—which means that the merits of the matter were NOT considered—the Third Section of this Tribunal had affirmed the actions taken by that municipal entity; or that, based on what was stated by that legality-review body—which performs an administrative rather than a judicial function, acting as the biphasic non-hierarchical appellate authority (jerarca impropio bifásico)—the Municipality’s actions must or may be understood to comply with the law. To claim otherwise, despite the clear fact that the aforementioned appeal was dismissed as untimely, plainly lacks any basis or legal and technical analysis.

In simple terms, if an appeal—such as the one under discussion—is declared inadmissible or “dismissed” as untimely, its substantive merits are obviously not considered, precisely because it was filed outside the prescribed statutory period—a ground for dismissal that, we clarify, this Chamber is not assessing as to whether it complies with the legal system. That is, the inadmissibility or “dismissal” of an appeal as untimely means that no legality review of the challenged conduct was conducted. At this point, it must be concluded that the actions of the respondent municipal entity, based on its assertion that it was acting due to the existence of binding opinions, reports, or recommendations issued by the CNE, are absolutely null and void (absolutamente nulo) because they clearly and manifestly violate the Principle Prohibiting Individual Derogation from Rules (Principio de Inderogabilidad Singular de las Normas), not only with respect to section 11.b) of the Regulatory Plan, but also sections 28—which prohibits “using or devoting land, buildings, or structures to any use incompatible with the established zoning”—and 29—which provides that “without the corresponding land-use certificate (certificado de uso), business licenses shall not be granted to commercial or industrial establishments”; both of the Ley de Planificación Urbana.

Accordingly, Administrative Resolution No. MLU-PAT-0127-2016 of 26 de enero de 2016, issued by the Dirección de Administración Tributaria and the Coordinación del Departamento de Patentes of the respondent Municipal Administration, which granted Hacienda San Rafael HRS S.A. Municipal License No. 04-0717 for the activity of “QUARRIES,” and all other related acts—whether prior or subsequent, procedural acts (actos de trámite), or procedural acts having independent legal effect (actos de trámite con efecto propio)—must be declared absolutely null and void. In this regard, for greater clarity, it must be stated that the invalidation ordered herein of the aforementioned Business License (Licencia Comercial) extends to official letters MLU-DJUR-023-2016, dated 19 de enero de 2016, and MLU-DJUR-480-2017 of 5 de junio de 2017, both signed by Licenciado Rommel Calvo Padilla, as well as Resolution MLU-DAM-DJUR-292-2016 of the 9:00 hours on 26 de mayo de 2016, issued by the Municipal Mayor’s Office, regarding which the Third Section of this Court dismissed the Appeal (Recurso de Apelación) on the grounds that it had been filed out of time.

Furthermore, any decision adopted by the municipal entity or any other Public Administration on the basis of the statements made by the aforementioned legal professional in the referenced official letters is likewise absolutely null and void. Given its significance, the ground for nullity (motivo de nulidad) upheld makes it unnecessary to rule on the remaining claims raised by the plaintiff. Notwithstanding the foregoing, this Court deems it appropriate to advise the municipal entity that, should any works have been carried out without a construction permit issued by that Local Government, its unavoidable duty is to proceed in accordance with the terms set forth in the Ley de Construcciones—Articles 93 et seq.— Regarding the Environmental Viability (Viabilidad Ambiental) and the Concession (Concesión) granted to the defendant company—grounds vi through xii—. In section 6, first paragraph, the Código de Minería provides that “all mining activity is declared to be of public utility (utilidad pública), both exploration and extraction activities.

The concentration, processing, transformation, and transportation of mineral substances, as well as privately or State-owned land required for those purposes, shall have the same status.” In this Chamber’s judgment, the foregoing demonstrates that the extraction and transportation of materials, including transportation across privately owned land, are deemed by law to be of public utility. Accordingly, since a statutory provision expressly declares that public utility, this Collegiate Body agrees with the State’s Counsel that the Executive Branch was not required to justify the public interest inherent in the concession granted to the co-defendant company through Resolution No. R-083-2015-MINAE. In this regard, having reviewed the administrative records (expedientes administrativos), this Court does not find that either Nombre3456 or the Dirección de Geología y Minas based their actions on any emergency or imminent risk; rather, as the Office of the Attorney General correctly contends, they understood from the outset of the proceeding that the co-defendant company’s application had the clearly commercial purpose of operating the Quarry (Cantera).

That circumstance explains the term and area granted under the concession, in keeping with the Código de Minería, because it was not and is not intended to address the risk of landslides in the area, but rather to ensure that the concession project is feasible. Consequently, there is not even tangential evidence of any breach of the Principles of Proportionality and Reasonableness (Principios de Proporcionalidad y Razonabilidad) arising from the term and area covered by the Concession at issue. Moreover, the positive impact that the aforementioned Concession has had in reducing landslide risk, as acknowledged at Trial by the expert witnesses Julio Eduardo Delgado Mora—a CNE geologist—and Etelberto Chavarría Camacho—an official of the Dirección de Geología y Minas—has absolutely nothing to do with the “reason” for which it was granted. From a strictly environmental and public-participation perspective, the alleged deficiencies are likewise not apparent, since the Environmental Impact Study (Estudio de Impacto Ambiental) prepared by the co-defendant company itself reflects the community consultation process involving the Concejo Municipal de La Unión, and the administrative record contains the notice published in a newspaper of nationwide circulation announcing the filing of that study and describing the concession project in question, with no indication that the plaintiff or any other interested party expressed opposition within the allotted period of 10 business days.

Continuing with this same issue of publicity and transparency, the record identified as No. 2754 shows that, during the proceedings for granting the Mining Concession (Concesión Minera), the corresponding public notice (edicto) was published in La Gaceta on 6 y 10 de junio del 2014, announcing the materials-extraction concession project requested by the co-defendant company, and that neither the plaintiff Association nor any other interested party submitted an objection within fifteen business days following the last publication. Lastly, it goes without saying that the matter concerning the Land-Use Certificate (Certificado del Uso de Suelo)—which in this case the Local Government unlawfully decided not to require—falls within the sole and exclusive jurisdiction of the Municipalidad de La Unión. In other words, for purposes of the Environmental Viability and the Concession at issue, Nombre3456 and the Dirección General de Geología y Minas were not legally required to demand the Land-Use Certificate issued by the defendant Municipality, because that and other requirements—such as the Health Operating Permit (Permiso Sanitario de Funcionamiento)—are necessary for other types of proceedings, such as commercial licenses, but not for processing the Environmental Viability and the Concession.

The foregoing demonstrates, among other things, the instrumental nature of the Environmental Viability (License) (Viabilidad (Licencia) Ambiental) granted through the aforementioned Resolution 2191-2013-SETENA, since that act does not exempt its recipient from obtaining the remaining permits from the competent authorities required by the Legal System (Ordenamiento Jurídico) in order to carry out the Quarry-extraction activity in this case. (For a clear discussion of the instrumental nature of the Environmental License, see Judgment No. 35-2009, issued at fifteen hours and nine minutes on catorce de enero de dos mil nueve by the Sixth Section of this Court.) Likewise, regarding the Concession granted through Resolution No. R-083-2015-MINAE, section 12 of the Código de Minería establishes the limited scope of that enabling title (título habilitante), and the concessionaire must comply with the remaining requirements set forth in the Legal System before extraction work may begin.

The latter—the scope of the Concession and the need to obtain the other permits, licenses, and authorizations from other Public Administrations—is also demonstrated by the responses to the questions submitted to the Registro Nacional Minero by both the Municipal Auditor and the defendant company. (Proven Facts Nos. 8, 9 and 13). Consequently, this Chamber finds no acts or omissions during the processing of the Environmental Viability and the Concession that could invalidate the actions taken by Nombre3456 and the Dirección de Geología y Minas. Continuing with the matter under analysis, this Court agrees with the Office of the Attorney General that, although the plaintiff challenges strictly technical aspects related to the intervention along the right bank of the Río Chiquito and the mitigation measures approved under the Environmental Viability (License), it does so on the basis of its own arguments and opinions, without reference to any technical basis substantiating its claims.

To the contrary, the list of proven facts contained in this Judgment, as well as the Trial testimony of the aforementioned officials, shows that both SETENA and the Dirección de Geología y Minas, when reviewing the co-defendant company’s application, took into account the high instability of the project area and its existing vulnerability, based on the conclusions of CNE Report No. DPM-INF-0852-2011. Thus, from a technical and scientific perspective, and as stated by the Office of the Attorney General, both Administrations determined that operating the Quarry, while fulfilling the purposes inherent in such activities, could serve as a measure to mitigate the risk of damming the Río Chiquito and help stabilize the soil mass. Accordingly, this Chamber finds no contradiction between the provisions of that initial CNE report and the issuance of the challenged acts. Regarding monitoring, given that the CNE expert witnesses acknowledged the existence of a monitoring system that, although different from the one sought by the plaintiff, has produced adequate results, this Chamber finds no technical or scientific basis for ordering it to be changed or for ordering any other additional measure concerning that issue.

Regarding the cleaning of the river channel, this is certainly a task that the defendant municipal entity must continue to perform in coordination with CNE; as for the “more detailed analyses” mentioned by the plaintiff, that request cannot be addressed because the plaintiff neither explains nor specifies what it means by that phrase and, in any event, the aforementioned officials from both CNE and the Dirección General de Geología y Minas stated at Trial that technical and scientific monitoring is being conducted in relation to the area’s vulnerability—landslides and the damming of the river—. In accordance with the foregoing, the claim concerning the actions of Nombre3456 and the Dirección General de Geología y Minas must be dismissed, as is hereby ordered. Nevertheless, because this Chamber considers the nullity declared herein to be evident and manifest—that is, egregious—it orders that this Judgment be transmitted to both the Contraloría General de la República and the Fiscalía Adjunta de Probidad, Transparencia y Anticorrupción, and that both the judicial record and the administrative records be made available to those authorities so that, within the scope of their respective powers, they may consider opening any investigations they deem appropriate, without any need to inform this Chamber of their ultimate decisions.

VI. OBJECTIONS RAISED

As indicated in Finding II of this Judgment, the representatives of the respondents raised the following objections:

  • 1)Hacienda San Rafael HSR S.A.: Failure to Exhaust Administrative Remedies (Falta de Agotamiento de la Vía Administrativa), Improper Joinder of Claims (Indebida Acumulación de Pretensiones), Lis Pendens (Litispendencia), Lack of Both Standing to Sue and Standing to Be Sued (Falta de Legitimación tanto Activa como Pasiva), and Failure to State a Legal Right (Falta de Derecho). (Images 264 to 292).
  • 2)Municipalidad de la Unión: Failure to Exhaust Administrative Remedies and, at trial during its opening statement, it alleged Lack of a Current Interest (Falta de Interés Actual). (Images 353 to 372, 412, and 416 to 444 of the court record. Electronic recording of the Oral and Public Trial Hearing).
  • 3)The State: Failure to State a Legal Right. (Images 376 to 407 of the court record). The preliminary defenses (defensas previas) of Failure to Exhaust Administrative Remedies, Lis Pendens, and Improper Joinder of Claims were rejected by the Pretrial Judge (Juzgador de Trámite) at the Preliminary Hearing by ruling No. 1925-2018 at catorce horas treinta y cinco minutos del veintinueve de noviembre de dos mil dieciocho. As to the objection of Lack of Standing raised in both respects by the co-defendant company, suffice it to say that it must be rejected because the company clearly must appear as a defendant in the action brought by the claimant, since it derives rights and legitimate interests from the challenged conduct. (Artículo 12.3 CPCA). With respect to the Lack of a Current Interest raised by the Municipal Representative, it must be rejected because, as of the date of this Judgment, there is no indication that the claimant’s claims have been satisfied at the administrative level or that, despite any of them being granted in these Proceedings, they would have no impact in the legal sphere. Put differently, ruling on the merits of this matter remains useful and, to that extent, current, since the Judgment will affect the legal sphere of those bound by this legal-procedural relationship. Lastly, regarding the objection of Failure to State a Legal Right raised by the Office of the Attorney General (Órgano Procurador), because the legal system does not support the arguments and relief sought against it, the appropriate course is to sustain that objection, as is hereby ordered.

VII. COSTS

Article 193 of the CPCA establishes that procedural costs and attorneys’ fees (costas procesales y personales) shall be imposed on the losing party merely by virtue of having lost, a ruling that must be made even sua sponte, pursuant to that same provision, in conjunction with section 119.2 ibídem. Waiver of such an award is permissible only: a) when, in the Court’s opinion, there was sufficient cause to litigate; b) when judgment is rendered on the basis of evidence unknown to the opposing party; or c) when there is an excessive claim (plus petitio), that is, when the difference between the relief claimed and that ultimately obtained is fifteen percent (15%) or more, unless the bases of the complaint are expressly deemed provisional or their determination depends on judicial discretion or an expert opinion (section 194 ibídem). In this case, this Chamber finds that, insofar as the action against Municipalidad de La Unión was successful, that entity—which, in this Court’s judgment, committed evident and manifest unlawful acts—must bear the procedural costs and attorneys’ fees in favor of the claimant.

As for the defendant company, it was joined in the Proceedings because it derived rights and interests from the challenged conduct and was therefore compelled to litigate; there is no indication that it litigated in bad faith, since the record reveals neither reckless procedural conduct nor an absurd position in defense of its legal sphere. Accordingly, as to that company, this matter is decided without a special award of costs. As for the State, it was joined in the Proceedings because two of its agencies were responsible for some of the challenged conduct, and the claim against it has been dismissed; therefore, the appropriate course as to the State is to rule without a special award of costs. Notwithstanding the foregoing dismissal, this Collegiate Body finds that the claimant Association should not bear costs in favor of the State, because it clearly had sufficient cause to litigate, given that the situation presented not only involves technical aspects of a science other than law—such as geology—but also that the legal issues in this matter are themselves highly complex.

This, coupled with the legal thicket created by the respondent Municipalidad in an attempt to “justify” its unlawful conduct, reasonably allowed the claimant Association to anticipate that everything might be void, including, obviously, matters relating to Environmental Feasibility (Viabilidad Ambiental) and the Concession (Concesión). Accordingly, it is reiterated that, in this Chamber’s view, the claimant Association had sufficient cause to bring its action against the State; therefore, despite the dismissal of its claim against that higher-level entity, the award of costs sought by the State’s Representative is denied.

POR TANTO

The evidence submitted by the State and the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias -CNE- to facilitate adjudication (prueba para mejor resolver) is admitted. The objections of Lack of Both Standing to Sue and Standing to Be Sued, as well as Lack of a Current Interest, are rejected. The action brought by the Asociación de Vecinos de la Urbanización Sierras de La Unión against Municipalidad de la Unión and Hacienda San Rafael HSR S.A. is granted in part and deemed denied insofar as relief is not expressly granted: i) Administrative Resolution No. MLU-PAT-0127-2016 dated 26 de enero de 2016, issued by the Dirección de Administración Tributaria and the Coordinación del Departamento de Patentes of the respondent Administración Municipal, whereby Hacienda San Rafael HRS S.A. was granted Municipal License No. 04-0717 for the activity of “QUARRIES” and all other acts connected with it—whether prior or subsequent, interlocutory, or interlocutory with independent legal effect—is annulled.

In this regard, for greater clarity, it must be stated that the invalidity ordered herein regarding the aforementioned Business License extends to official communications MLU-DJUR-023-2016, dated 19 de enero de 2016, and MLU-DJUR-480-2017 dated 5 de junio de 2017, both signed by Licenciado Rommel Calvo Padilla, as well as Resolution MLU-DAM-DJUR-292-2016 at 9:00 horas del 26 de mayo de 2016, issued by the Alcaldía Municipal, with respect to which the Sección Tercera of this Court rejected the Appeal (Recurso de Apelación) as untimely filed. Furthermore, any decision adopted by the municipal entity or any other Public Administration on the basis of the statements made by the aforementioned legal professional in those official communications is likewise absolutely void. ii) The municipal entity shall take note of the statements in this Judgment regarding the procedure to be followed when structures have been built without a municipal permit. iii) The procedural costs and attorneys’ fees shall be borne by Municipalidad de la Unión, with their amount to be determined during the Judgment Enforcement Stage (Etapa de Ejecución de Sentencia) at the request of the prevailing Association.

As to co-defendant Hacienda San Rafael H.R.S. S.A., judgment is entered without a special award of costs. iv) Because this Chamber considers the invalidity declared herein to be evident and manifest—that is, egregious—this Judgment shall be transmitted both to the Contraloría General de la República and to the Fiscalía Adjunta de Probidad, Transparencia y Anticorrupción, and both the court record and the administrative records shall be made available to those authorities so that, within the scope of their powers, they may consider initiating any investigations they deem appropriate, without any need to inform this Chamber of their ultimate decisions. Insofar as the action was brought against the State, the objection of Failure to State a Legal Right is sustained and, consequently, the action is dismissed in its entirety; for the reasons stated in that regard, the matter is decided without a special award of costs. SECCIÓN CUARTA DEL TRIBUNAL CONTENCIOSO ADMINISTRATIVO. Segundo

Circuito Judicial de San José, Anexo A, Dirección01 , a las diez horas treinta minutos del cuatro de enero de dos mil veintidós.

Proceso de Conocimiento interpuesto por ASOCIACIÓN DE VECINOS DE LA URBANIZACIÓN SIERRAS DE LA UNIÓN -ASOCIACIÓN-, cédula jurídica CED82762, representada por su Apoderado Especial Judicial, Licenciado Bernal Gamboa Mora, carnet CED87536 contra la MUNICIPALIDAD DE LA UNIÓN -MUNICIPALIDAD-, representada por su Apoderada Especial Judicial, Licenciada Eida Barrantes Román, carnet CED87537, el ESTADO, representado por el Procurador Alonso Arnesto Moya, carnet CED87538 y HACIENDA SAN RAFAEL H.R.S. S.A. , cédula jurídica CED87539, representada por su Apoderado Especial Judicial, Licenciado Luis Antonio Álvarez Chaves, carnet CED87540. Participan como Terceros Interesados, el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN -SINACrepresentado por su Apoderado Especial Judicial, Licenciado Christian Barrero Godínez, carnet 20302 y la COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS -CNE-, representada por su Apoderada Especial Judicial, Licenciada Maureen Solís Retana, carnet 16239.

RESULTANDO

I.Conforme al escrito de demanda, la parte actora interpuso este Proceso, esgrimiendo las siguientes pretensiones:"1. De conformidad al artículo 42 incisos a) y b) del CPCA, respetuosamente solicito la declaración de disconformidad de las siguientes conductas administrativas con el ordenamiento jurídico y de todos los actos o las actuaciones conexas, así como la anulación de todos estos actos: a. La Licencia o Patente Comercial N° 04-717 y actos conexos. b. La Viabilidad Ambiental dada mediante resolución 2191-2013-SETENA, al proyecto denominado "Estabilización de deslizamiento con extracción de cantera" a nombre de la sociedad Hacienda San Rafael H.S.R. S.A. y actos conexos. c. La resolución R-0832015-MINAE donde el presidente de la República Luis Guillermo Solís Rivera y la Ministra de Ambiente y Energía Patricia Madrigal Cordero otorgaron a Hacienda San Rafael H.S.R. S.A. la concesión de explotación de materiales, y actos conexos. 2.

De conformidad al artículo 42 incisos c), d) y f) y el 99 incisos c) y f) de la Ley Orgánica del Ambiente, en caso de no declararse la nulidad de las anteriores conductas, respetuosamente solicito se ordene la cancelación de todas esas conductas y actos conexos, por los incumplimientos de las obligaciones legales y contractuales indicados en esta demanda, y se ordene la ejecución de la garantía ambiental. 3. De conformidad al artículo 42 inciso i) del CPCA, respetuosamente solicito que se ordene a la Administración Pública, que se abstenga de adoptar y ejecutar cualquier conducta con la pretensión de revivir esta concesión, sin previamente tener los estudios técnicos respectivos. 4. De conformidad al articulo 42 incisos e), g) y j), del CPCA, y el 99 de la Ley Orgánica del Ambiente, respetuosamente solicito se condene a los demandados a demoler y/o eliminar las obras efectuadas, a reparar el daño ambiental causado y a establecerles obligaciones compensatorias al daño causado.

De igual manera, solicito se ordene a la Municipalidad de la Unión de Tres Ríos a establecer un sistema de monitoreo, en tiempo real utilizando cámaras y pluviómetros, control del movimiento del sector inestable en el sector de Las Casuelas (sic) utilizando (GPS); establecer sistemas de alerta con sirenas y medios electrónicos, realizar limpieza del cauce, así como un proceso de análisis más detallado de los movimientos del terreno y los distintos escenarios ante un derrumbe mayor, donde se establezcan los mapas de vulnerabilidad ante posibles derrumbes en este sector de las Cazuelas. 5. De conformidad al articulo 193 del CPCA, respetuosamente solicito se condene a los demandados al pago de las costas de este proceso, pues nosotros nos hemos visto obligados a litigar en el presente asunto, para anular o cancelar los actos impugnados. 6. De conformidad al artículo 42 incisos f) y g) del CPCA, el 98 de la Ley Orgánica del Ambiente, el artículo 199 y siguientes de la LGAP y del 67 y siguientes de la Ley Orgánica de la Contraloría General de la República, una vez declarada con lugar esta demanda, respetuosamente solicitamos se testimonien piezas a la Contraloría General de la República, a efecto que se realicen las investigaciones administrativas para sancionar y cobrar los daños y perjuicios a los funcionarios responsables de las nulidades o caducidades declaradas con esta demanda. 7.

De conformidad al artículo 42 incisos f) y g) del CPCA, declarada con lugar esta demanda, y si el Tribunal considere que pudo existir algún tipo de delito en los hechos y actos base de la misma, respetuosamente solicito se testimonien piezas al Ministerio Público para su debida investigación. PETITORIA SUBSIDIARIA. 1. De conformidad al artículo 42 inciso c), g) y j), del CPCA, y el 99 de la Ley Orgánica del Ambiente, en caso de no ser posible la anulación o cancelación de la Licencia o Patente Comercial No. 04-717 y actos conexos, la Viabilidad Ambiental dada mediante resolución 2191-2013-SETENA y la resolución R-083-2015-MINAE de otorgamiento de la concesión, respetuosamente solicito que previo a su ejecución, se realicen los estudios técnicos necesarios conforme la recomendación de la CNE, a efecto de garantizar que no se inestabilizará aún más el terreno con las obras realizadas, de igual manera, solicito se ordene a la Municipalidad de la Unión de Tres Ríos establecer un sistema de monitoreo, en tiempo real, utilizando cámaras y pluviómetros, control del movimiento del sector inestable en el sector de Las Casuelas (sic) utilizando (GPS), establecer sistemas de alerta con sirenas y medios electrónicos, realizar limpieza del cauce, además de realizar un proceso de análisis más detallado de los movimientos del terreno y los distintos escenarios ante posible derrumbe mayor, donde se establezcan los mapas de vulnerabilidad ante posibles derrumbes en este sector de las Cazuelas. 2.

De conformidad al artículo 193 del CPCA, respetuosamente solicito se condene a los demandados al pago de ambas costas de este proceso, pues mi representada se ha visto obligada a litigar en el presente asunto, con el objetivo depara (sic) anular o cancelar los actos aquí impugnados. 3. De conformidad al artículo 42 incisos f) y g) del CPCA, el 98 de la Ley Orgánica del Ambiente, el articulo 199 y siguientes de la LGAP y del 67 y siguientes de la Ley Orgánica de la Contraloría General de la República, al declararse con lugar esta demanda, respetuosamente solicito se testimonien piezas a la Contraloría General de la República, a efecto que se realicen las investigaciones administrativas dirigidas a sancionar y cobrar los daños y perjuicios a los funcionarios responsables de las nulidades o caducidades declaradas en esta demanda 4. De conformidad al artículo 42 incisos f) y g) del CPCA, al declararse con lugar esta demanda, si el Tribunal considerare que pudo existir algún tipo de delito proveniente de los hechos y actos acá discutidos, respetuosamente solicito se

testimonien piezas al Ministerio Público, para su debida investigación." (Imágenes 2 a 60 del expediente judicial. Respaldo electrónico de la Audiencia Preliminar).

II.Conferido el traslado de ley, la representaciones de las accionadas contestaron negativamente la demanda y opusieron las siguientes excepciones: 1) Hacienda San Rafael HSR S.A.: Falta de Agotamiento de la Vía Administrativa, Indebida Acumulación de Pretensiones, Litispendencia, Falta de Legitimación tanto Activa como Pasiva y Falta de Derecho. (Imágenes 264 a 292). 2) Municipalidad de la Unión: Falta de Agotamiento de la Vía Administrativa y en Juicio durante su Alegato de Apertura adujo la Falta de Interés Actual. (Imágenes 353 a 372, 412 y 416 a 444 del expediente judicial. Respaldo electrónico de la Audiencia de Juicio Oral y Público). 3) Estado: Falta de Derecho. (Imágenes 376 a 407 del expediente judicial).

III.La Audiencia Preliminar en el presente Proceso, se llevó a cabo en fecha 29 de noviembre de 2018. (Imágenes 670 a 680 del expediente judicial. Respaldo electrónico de la referida Audiencia).

IV.El Juicio Oral y Público se llevó a cabo a las 8:30 horas del 24 de noviembre de 2021, mismo en el cual se concedió audiencia por tres días hábiles a las partes, a afecto de que se refirieran a la prueba para mejor resolver aportada tanto por el Estado como por la representación de la CNE, se evacuó la prueba admitida en la Audiencia Preliminar y previo al cierre del debate, se brindó la oportunidad a las partes de emitir sus respectivas conclusiones. V.Se dicta esta Sentencia, previa deliberación de los integrantes del Tribunal, dentro del plazo de quince días hábiles establecido en el artículo 111.1 del Código Procesal Contencioso Administrativo -al haberse declarado complejo el presente asunto-, sin que se observen causales capaces de invalidar lo actuado. Plazo el anterior que debe ser computado excluyendo los tres días hábiles concedidos a las partes a efecto de que se manifestaran sobre la prueba para mejor resolver y los días correspondientes al cierre colectivo de fin de año.

Redacta el Juez Baltodano Gómez, con el voto afirmativo de los juzgadores (as) Reyes Castillo y Salas Leitón.

CONSIDERANDO

I.SOBRE LA PRUEBA PARA MEJOR RESOLVER.- Tal y como se desprende de los autos, previo a la celebración del Juicio Oral y Público, con justificación oral durante el mismo, tanto el Estado como la CNE aportaron prueba documental a efecto de que fuera valorada su admisibilidad como prueba para mejor resolver. Por parte de la Representación Estatal se incorporaron a lo autos los siguientes documentos: 1. Informe DGM-CRC1-048-2019 del 26 de junio de 2019, emitido por el Lic. Esteban Bonilla Elizondo, Geólogo, Coordinador minero de la Región Central de la Dirección de Geología y Minas, que es Respuesta a ADPb4466-2019. Informe del estado del expediente 2754. Hacienda San Rafael H.S.R. S.A., Dirección13110 , . 2. Informe DGM-CRC1-085-2019 del 16 de diciembre de 2019, emitido por el Lic. Esteban Bonilla Elizondo / Geólogo, Coordinador minero de la Región Central de la Dirección de Geología y Minas, que es Atención a denuncia SITADA-6353-2016. Área de Expediente 2754, Dirección13111 , San Rafael, La Unión. 3. Informe DGM-CRC1-0082020 del 28 de enero del 2020, emitido por el Lic. Esteban Bonilla Elizondo / Geólogo, Coordinador minero de la Región Central de la Dirección de Geología y Minas, que es Control Expediente 2574 Hacienda San Rafael HSR S.A. Dirección13110 , . 4. Informe DGMTOP-O-171-2020 del Dirección13112 , emitido por el Ing. Etelberto Chavarría

Camacho, de la Dirección de Geología y Minas, que es Informe de inspección a solicitud de la Procuraduría General de Costa Rica. 5. Informe Técnico CNE-UIAR-INF-0595-2021 del Dirección13113 , emitido por el M.Sc Julio Edo. Madrigal Mora, Geólogo de la Unidad de Investigación y Análisis del Riesgo de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, que es seguimiento al Deslizamiento del Río Chiquito, del proyecto de estabilización y aprovechamiento del material pétreo por parte del Tajo Hacienda San Rafael, se efectúa una visita con el Comité Municipal de Emergencias -CME- de La Unión, con la finalidad de conocer el estado actual y de las acciones que se están estableciendo a partir de junio-2021 y a futuro. 6. Informe DGM-CRC1-103-2021 del Dirección13114 , emitido el Lic. Esteban Bonilla Elizondo / Geólogo, Coordinador minero de la Región Central de la Dirección de Geología y Minas, que es Control Expediente 2754.

Respuesta a CNE-UIARINF-0595-2021. Hacienda San Rafael HSR S.A. San Rafael, La Unión. 7. Informe DGM-TOPO-361-2021 del 18 de noviembre de 2021, emitido por el Ing. Etelberto Chavarría Camacho, de la Dirección de Geología y Minas, que es Informe de inspección # 16 de monitoreo de deslizamiento. Expediente 2754 Tajo San Rafael. 8. Copia del permiso sanitario de funcionamiento del Ministerio de Salud N°CSARS-CU-205-2019 del 29 de marzo de 2019, emitido por el Área Rectora de Salud de Curridabat. Por su parte, la Representación de la CNE, allegó al expediente: 1. El informe técnico CNE-UIAR-INF-0595-2021 elaborado por el Geólogo Julio Madrigal Mora, dirigido a la Municipalidad de la Unión como parte del seguimiento que la Comisión da al deslizamiento activo del Río Chiquito. 2. Copia de la Sentencia de primera instancia No. 26-2021-IX del expediente 16-005584-1027-CA mediante la cual se acogió la excepción de Falta de Legitimación Ad Causam Pasiva a favor de la CNE.

De la documentación indicada, este Órgano Colegiado confirió audiencia a las demás partes en los términos previstos por el ordinal 50.2 del CPCA, por un período de tres días hábiles con suspensión del plazo para el dictado del presente Fallo. Con ocasión de la normativa aplicada, se indicó de manera oral a las partes que sobre la admisibilidad de tales documentos esta Cámara se pronunciaría en Sentencia. Criterio de este Tribunal. Es sabido que este tipo probanzas aunque fueren ofrecidas por las partes, son del Tribunal -en este caso-, quien tiene amplia discrecionalidad para determinar si la prueba resulta útil y pertinente para resolver por el fondo el asunto sometido a su conocimiento. En la especie, analizada la documentación dicha, observa este Órgano Jurisdiccional que toda ella se encuentra vinculada a la temática y objeto del presente Proceso y en ese tanto, la misma deviene en relevante, útil y pertinente. De ahí que, procede su admisión como en efecto se dispone.

II.DE LOS HECHOS PROBADOS.- De importancia para la resolución de la presente litis, se tienen como debidamente acreditados los siguientes: 1) Que a principios de los años ochentas, en la margen derecha del río Chiquito justo en el área que corresponde a la concesión que se dirá en hechos posteriores, ocurrió un deslizamiento importante que represó el río, desencadenando una avalancha que derivó en daños a infraestructura de esta ciudad y poblaciones adyacentes. (Oficio DGM-DCM-012-2016 del 24 de febrero de 2016, emito por la Jefatura de Control Minero y visible a folios 404 y 405 del expediente administrativo municipal); 2) Que mediante Informe DPM-INF-0852-2011 de fecha setiembre 2011, realizado por el Geólogo Julio Eduardo Madrigal Mora de la CNE, el mismo señaló entre otras cosas lo siguiente: "Indudablemente es necesario implementar un Sistema de Alerta Temprana que involucre a la población de las parte (sic) baja de la micro-cuenca del Río

Chiquito." (Folios 1 a 3 del expediente administrativo físico aportado por la Municipalidad);

  • 3)Que mediante Certificación SINAC-D-ACCVC-0610-2013 del 31 de julio de 2013, se indicó en lo de interés, que: "se ha determinado con base en la ubicación consignada en el plano catastrado número C-4022-1969, propiedad de QUEBRADOR SAN RAFAEL S.A. con Folio Real 3065878-000, que este describe un terreno que se ubica FUERA DE CUALQUIER ÁREA SILVESTRE PROTEGIDA SEA CUAL SEA SU CATEGORÍA DE MANEJO ADMINISTRADA POR EL MINISTERIO DE AMBIENTE, ENERGÍA Y MINAS." (Folio 15 del expediente administrativo físico aportado por la Municipalidad. La mayúscula, negrita y subrayado corresponden al original);
  • 4)Que mediante resolución No. 2191-2013SETENA de las ocho horas quince minutos del veintinueve de agosto de dos mil trece, la Secretaría Nacional Ambiental, dispuso en lo de interés: "Descripción del Proyecto: Consiste en desarrollar la extracción de materiales en cantera, se extraerán brechas y lavas, las cuales serán procesadas con el uso de un quebrador primario, secundario y clasificación mediante cribas. La fragmentación del material requerirá del uso de explosivos. Se pretende suministrar agregados gruesos y finos para la fabricación de concretos de cementos hidráulicos y asfálticos en la industria de la construcción. El área solicitada en concesión es de 19 ha 9050 m2 para un plazo de 15 años. Por lo que se le otorga la VIABILIDAD (Licencia) AMBIENTAL al proyecto, quedando abierta la etapa de Gestión Ambiental y en el entendido de cumplir con la Cláusula de Compromiso Ambiental fundamental, indicado en el Considerando Tercero anterior." (Folios 16 a 18 del expediente administrativo físico aportado por la Municipalidad. La negrita, mayúscula y subrayado, corresponden al original);
  • 5)Que mediante oficio DST-004-14 del 24 de enero de 2014, suscrito por el Ing. Renato Jiménez Zúñiga, Jefe del Departamento de Servicios Técnicos del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria -INTA-, dirigido al señor Nombre110780 en su condición de representante legal de Hacienda San Rafael HSR S.A., se indicó, en lo de interés lo siguiente: "Con relación a su solicitud del pasado 20 de enero 2014, me permito indicarle que esta Dependencia ha revisado y aprobado el documento denominado "ESTUDIO DETALLADO DE SUELOS Y CAPACIDAD DE USO DE LAS TIERRAS DE LA PROPIEDAD PERTENECIENTE A HACIENDA SAN RAFAEL HSR S.A., levantado por los ingenieros agrónomos ROY McDONALD BOURNE M., MSc., y JORGE ACÓN HO, certificadores de uso conforme del suelo autorizados (No. 06 y No. 16 respectivamente ... Así las cosas, y de acuerdo a los alcances científicos y técnicos de la investigación edafológica realizada por los ingenieros McDonald y Acón; y a tenor de lo establecido en el Artículo 66 de la ley No. 7779, de Uso, Manejo y Conservación de Suelos... es que esta instancia considera que de otorgarse por la Dirección de Geología y Minas del MINAE, una concesión para la extracción áridos para tajo, para la sección estudiada (8.43 ha), no se estará causando una pérdida a la productividad de los suelos del cantón de La Unión, en virtud a que las limitaciones de las tierras fehacientemente demostradas en la investigación realizada, no permiten una producción agrícola rentable y competitiva." (Imágenes 92 a 93 del expediente judicial. La mayúscula y negrita corresponden al original. El subrayado es nuestro);
  • 6)Que mediante resolución R-0083-2015-MINAE de las nueve horas cuarenta minutos del veinte de marzo de dos mil quince, suscrita por el entonces Presidente de la República, señor Luis Guillermo Solís Rivera y la en ese momento Ministra a.i. de Ambiente y Energía, señora Patricia Madrigal Cordero, se dispuso otorgar "Concesión de Extracción de Materiales en una Cantera" por el plazo de 15 años a favor de Hacienda San Rafael HSR S.A. (Folios 201 a 205 del expediente administrativo municipal);
  • 7)Que mediante Constancia de Uso de Suelo, Resolución Municipal de Ubicación SSPU-1110-15-8800701 del 13 de agosto de 2015, el Arquitecto José Carlos Barrantes Cubillo, en su condición de Coordinador de Planificación Urbana de la Municipalidad de La Unión, señaló: "SOLICITANTE:

Nombre110780 . PLANO DE CATASTRO: Placa19467. ZONA: ZONA DE PROTECCIÓN FORESTAL. USO: CONSULTA. ACTIVIDAD: INFORMATIVO. Zona de Protección Forestal: Propósitos. Esta zona es necesaria para retener el desarrollo urbano y continúan en ella el uso forestal. 4. Usos permitidos: 1. Forestales. 5. (sic) Vivienda unifamiliar con características suburbanas, quedan excluidos en todo caso los conjuntos residenciales y las urbanizaciones de cualquier tipo. 6. (sic) Viveros. 4. (sic) Zonas ecoturísticas. Usos condicionales. No se permitirán usos condicionales. NOTA: TERRENO CON AFECTACIÓN POR RIESGO POTENCIAL DE SOCAVAMIENTO DE RÍO Y CON ANTECEDENTES DE DESLIZAMIENTOS IMPORTANTES (SOLICITAR CRITERIO A LA COMISIÓN NACIONAL DE EMERGENCIAS). LA ZONA NO PERMITE ACTIVIDAD DE CANTERA, SEGÚN EL ARTÍCULO 11.b. DEL REGLAMENTO DEL PLAN REGULADOR VIGENTE DEL CANTÓN DE LA UNIÓN. UN USO DE SUELO NO ES NI OTORGA PERMISO O LICENCIA MUNICIPAL" (Imágenes 114 a 115 del expediente judicial);

  • 8)Que mediante oficio MLU-AI-552-2015 del 6 de octubre de 2015, la señora Auditora de la Municipalidad de La Unión, formuló una serie de consultas a la Jefatura del Registro Nacional Minero relacionas con la concesión otorgada a la empresa codemandada, siendo de interés para el asunto que se analiza las interrogantes números 3, 4 y 5, en las que expresamente consultó: "3. ¿Es cierto que bajo la concesión extendida por el MINAE a la empresa Hacienda San Rafael H.S.R. Sociedad Anónima, se incluyen las licencias para la excavación, el movimientos de tierra, la construcción de ciertas obras, el terraceo, aún cuando la Ley de Construcciones en sus artículos 1, 55 y 74 señala que para todo tipo de obra constructiva, es necesario contar con la licencia municipal para dicho fin? 4. ¿Dentro de los requisitos que exige la Dirección de Geología y Minas del MINAE, a través del Código de Minería u otra normativa, establece como parte de los requisitos para la obtención de una concesión como la que aquí se indica, el uso de suelo debidamente aprobado de previo por la Municipalidad involucrada, tal y como lo señala la Ley de Planificación Urbana y las potestades municipales para planificar el Desarrollo Urbano? 5. ¿Podría considerarse que el otorgamiento de una concesión por parte del MINAE, faculta en forma implícita al concesionario, la exoneración para tramitar las licencias constructivas y de movimiento de tierras que establece la normativa urbana, así como el cambio de uso de suelo que establezca un plan regulador de un municipio?" (Folios 142 a 145 del expediente administrativo municipal);
  • 9)Que en atención al oficio indicado en el hecho probado inmediato anterior, la Jefatura del Registro Nacional Minero, mediante oficio DGM-RNM-9852015 del 16 de noviembre de 2015 dio respuesta a las interrogantes formuladas por la Unidad de Auditoría Interna de la Municipalidad de La Unión, indicando respecto de las preguntas 3, 4 y 5, lo siguiente: "3. Según lo dispuesto por el artículo 12 del Código de Minería, la concesión de explotación es un derecho real limitado, que nace de un acto administrativo y soberano del Estado, en virtud del cual éste, sin perder el dominio, autoriza a personas físicas o jurídicas, únicamente para realizar actividades de explotación de los yacimientos o depósitos minerales, bajo las condiciones y requisitos que establecen esta ley, su reglamento y otras leyes especiales. Es decir, el otorgamiento de la concesión, no exime al concesionario de cumplir en forma íntegra con todas las demás regulaciones, trámites, normas técnicas o legales vigentes en el país y, que deberán cumplirse antes (sic) otras instituciones del Estado. De ahí que la concesión minera no incluye ninguna licencia constructiva o del (sic) cualquier otro tipo." 4. Dentro de los requisitos que debe cumplir todo interesado en obtener una concesión de explotación, según lo dispuesto por el Código de Minería y su reglamento, no se requiere la presentación de uso de suelo aprobado por la Municipalidad del lugar donde se ubica el área solicitada. No obstante, tal y como se indicó en el punto segundo del presente oficio, de conformidad a lo dispuesto por el artículo 25 del Código de Minería y el artículo 24 del Reglamento No. 29300, para el caso de las concesiones de explotación de Cantera, se deberá contar con la aprobación de un Estudio de Uso Conforme del Suelo por parte del departamento correspondiente del Ministerio de Agricultura y Ganadería, es decir del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA)." "5. Sobre esta interrogante, se reitera lo indicado en el punto 3 del presente oficio, en cuanto a que, el otorgamiento de una concesión, no exime al concesionario de cumplir en forma íntegra con todas las demás regulaciones, trámites, normas técnicas o legales vigentes en el país y, que deberán cumplirse ante otras instituciones del Estado." (Folios 133 a 140 del expediente administrativo municipal);
  • 10)Que mediante escrito de fecha 16 de noviembre de 2015, en el cual se consignó como "Asunto.- Cambio de Uso de Suelo. Licencia de Comercialización de Materiales Extraídos en Cantera. Deslizamiento Río Chiquito", el señor Nombre110780 , cédula CED87541, en su condición de propietario a esa fecha del inmueble del Partido de Cartago, matrícula de Folio Real No. Placa19468 catastrado Placa19469, peticionó al Concejo Municipal de la Unión, lo siguiente: "Con base en los argumentos de hecho y derecho expuestos, estudios y pruebas técnicas que los sustentan y ante la necesidad apremiante y comprobada de ejecutar las obras descritas, SOLICITO a esta Municipalidad modificar el USO DE SUELO para el inmueble de mi propiedad de manera que se AUTORICE LA COMERCIALIZACIÓN DEL MATERIAL EXTRAÍDO EN CANTERA que posibilitará la financiación de la estabilización del deslizamiento del Río Chiquito. Todo sujeto a los parámetros, obligaciones, compromisos y limitaciones establecidas en Resolución R-0083-2015-MINAE que es Concesión de Extracción de Materiales en una Cantera por un plazo de quince años." (Folios 119 a 131 del expediente administrativo municipal. La mayúscula, negrita y el subrayado, corresponden al original);
  • 11)Que mediante oficio No. MLU-DJUR-023-2016, fechado 19 de enero de 2016, el Director Jurídico de la Municipalidad de la Unión, Lic. Rommel Calvo Padilla se refirió al tema del Uso de Suelo respecto de la mencionada concesión, indicando -en lo de interés- lo siguiente: "(...) La determinación del uso del suelo se enmarca dentro de la normativa urbana, de manera que el uso permitido es el que determine cada municipio en el plan regulador y su reglamento de zonificación vigente, o en su defecto, con base en el Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones, en caso de no contarse con plan regulador (artículo 169 constitucional; Ley 4240, numerales 15, 16, inciso c); 21, 24 y Transitorio II, dictamen C-327-2001). Cabe agregar que el Código Sísmico tiene disposiciones específicas sobre las zonas de riesgo geológico, de acatamiento obligatorio para las municipalidades. También debe considerarse como marco jurídico y técnico para la prevención de riesgos, la Ley No. 8488 y su Reglamento, conforme a las cuales la Comisión Nacional de Emergencias ostenta la competencia máxima para dictaminar situaciones de riesgo, emergencia y peligro inminente, por lo que puede y debe establecer los criterios técnicos para orientar las decisiones municipales sobre las áreas de riesgo dentro de los procesos de planificación territorial que podría generar limitaciones a la propiedad privada. (dictamen C-308-2013). Y, si bien como dijimos, los planes reguladores son de acatamiento obligatorio para los administrados y la Administración, pues ostentan naturaleza normativa (C-100-1995, C-93-2007, OJ-11-1996 y OJ-42-2005), por razón de su jerarquía acto de administrativo de carácter general (sentencias constitucionales 6653-2000 y 42522002; opinión jurídica OJ-011-1996)- no pueden vulnerar normas de rango superior como la ley tratados ni modificar el destino previsto para los bienes demaniales (OJ-42-2005). De manera que ante una eventual dicotomía de orden jurídico, los funcionarios públicos deben aplicar la norma de grado superior (Constitución Política, artículo 11; Ley 6227, numerales 6 y 11). (...) Con vista en la normativa antes transcrita derivada de la ley 8488, donde se establece que los informes técnicos de la CNE son de acatamiento obligatorio para las instituciones públicas y sobre todo para las Municipalidades, se desprende de la jurisprudencia citada por la Junta Directiva de la CNE, de la Sala Constitucional y de la Procuraduría General de la República que las autoridades municipales deben proceder a enfrentar el deslizamiento identificado en la margen derecha del río chiquito, en forma ineludible. Para estos efectos, conviene aprovechar la concesión de explotación de cantera autorizada por el MINAE y la Dirección de Geología y Minas para que se brinde el adecuado manejo de taludes y limpieza de cauce del río chiquito. Para el cumplimiento de esta conclusión, recuérdese que el uso de suelo en la finca perteneciente a Hacienda San Rafael HSR. S.A., como objeto de la concesión de extracción de materiales, se fundamenta no solo en la concesión otorgada sino como bien los expresa el MSC. Róger Ovares, "... una concesión minera con un adecuado programa de explotación; puede coadyuvar en mitigar los riesgos e impactos ocasionados por un deslizamiento..." Con base en lo anterior, existe suficiente base normativa y legal para que el concesionario Hacienda San Rafael HSR S.A., pueda iniciar sus actividades de explotación pétrea, sin mayor cuestionamiento, amparado al Código de Minería así como a la Ley de Emergencias 8488. Para estos efectos, el concesionario deberá gestionar lo pertinente ante la Dirección Tributaria a fin de obtener la correspondiente licencia comercial." (Folios 158 a 167 del expediente administrativo municipal);
  • 12)Que mediante Resolución Administrativa No. MLU-PAT-0127-2016 del 26 de enero de 2016, emitida por la Dirección de Administración Tributaria y la Coordinación del Departamento de Patentes de la Administración Municipal accionada, se dispuso otorgar a la empresa Hacienda San Rafael HRS S.A. la Licencia Municipal No. 04-0717 para la actividad de "TAJOS". (Imágenes 111 a 112 del expediente judicial).
  • 13)Que mediante oficio DGM-RNM473-2016 del 14 de noviembre de 2016, emitido por la Jefatura del Registro Nacional Minero en respuesta a consulta formulada por la empresa codemandada Hacienda San Rafael HSR S.A., se indicó en lo de interés: "La consulta se refiere puntualmente al hecho de que si para ejercer el derecho que el Poder Ejecutivo otorgo (sic) a la concesionaria del expediente minero No. 2754, es necesario contar con el Permiso Sanitario de Funcionamiento, para la extracción de materiales en cantera. (...) La aplicación del principio general de la inderogabilidad singular de la norma; principio general de rango constitucional, es aplicable a la totalidad del ordenamiento jurídico, como derivación y a la vez condición del Estado de Derecho en su integridad. (...) Así las cosas, es necesario indicar que para el desarrollo de la actividad extractiva en una concesión se requiere entre otras cosa (sic) por ejemplo contar con patente comercial, si la actividad se efectúa con intereses comerciales; para desarrollar la actividad se hace necesario contar con empleados que ejecuten distintas labores, los cuales deben contar con las garantías sociales que se establece (sic) en el régimen de seguridad social; igualmente deben cumplirse con las disposiciones del Ministerio de Salud, ya que dentro de la normativa a nivel nacional se encuentra el Decreto No. 34728- S, que es el "REGLAMENTO GENERAL PARA EL OTORGAMIENTO DE PERMISOS DE FUNCIONAMIENTO DEL MINISTERIO DE SALUD", en la categoría "Grupo de Riesgo A", incluye en la tabla de clasificación de establecimientos y actividades regulados por el Ministerio de Salud, según el Riesgo Sanitario Ambiental, en la categoría C: Explotación de Minas y Canteras, en la División 14 Explotación de otras Minas y Canteras, en el grupo 141, numeral 1410 "EXTRACCIÓN DE PIEDRA, ARENA, Y ARCILLA (TAJOS)... Ante lo indicado anteriormente, se debe concluir que para el ejercicio efectivo del derecho de concesión otorgado por el Poder Ejecutivo, no solo es necesario el cumplimiento de la normativa establecida en el Código de Minería y su Reglamento, sino que además se deben acatar las normas de otras leyes especiales, que no pueden derogarse en forma singular un caso particular." (Folios 394 a 395 del expediente administrativo municipal);
  • 14)Que mediante oficio MLU-DJUR-480-2017 del 5 de junio de 2017, el Director Jurídico de la Municipalidad de la Unión, Lic. Rommel Calvo Padilla, dirigido al señor Alcalde Municipal, indicó en lo de interés: "El Tribunal en resolución final de las 15 horas del 21 de abril del 2017... dispuso: (...) el recurso de apelación resulta abiertamente extemporáneo, al haberse interpuesto hasta el 28 de marzo de 2016; lo que obliga a su rechazo tal y como lo declaró la autoridad municipal en la resolución recurrida, MLU-DAM-DJUR-2922016 ... POR TANTO Se confirma lo resuelto por la Alcaldía Municipal de la Unión en la resolución No. MLU-DAM-DJUR-292-2016 de las 9:00 horas del 26 de mayo de 2016 y se da por agotada la vía administrativa sobre lo resuelto." Esta resolución judicial evidencia que lo actuado y resuelto por la Municipalidad en la Expedición (sic) de la licencia comercial se dio conforme al ordenamiento jurídico." (Folios 453 a 454 del expediente administrativo municipal. La negrita y mayúscula corresponden al original);
  • 15)Que la sociedad Hacienda San Rafael HSR S.A., cédula jurídica CED87539 es propietaria del inmueble del partido de Cartago, matrícula de Folio Real No. Placa19470, con plano catastrado C-4022-1969. (Folios 176 a 177 del expediente administrativo municipal).

III.DE LA POSICIÓN DE LAS PARTES.- En síntesis y sin perjuicio de la literalidad de sus argumentaciones, las cuales han sido estudiadas en su totalidad por este Tribunal, cada una de las partes alegan lo que seguidamente se detalla en este apartado. ASOCIACIÓN ACTORA: Que el 14 de mayo del 2003 se publicó en la Gaceta No. 91 el Plan Regulador de la Municipalidad de la Unión de Tres Ríos, que estableció como zona de protección forestal la zona donde se ubica la finca Matrícula de Folio Real No. Placa19470, propiedad de la sociedad Hacienda San Rafael H.S.R. S.A. En esa zona sólo se permiten los usos forestales, la vivienda unifamiliar, los viveros, y las zonas eco turísticas. No se permiten usos condicionales y mucho menos la actividad de cantera. Que el 28 de enero de 2011, los representantes legales y apoderados generalísimos de Hacienda San Rafael S.R.L. Sociedad Anónima, cédula jurídica número CED87539, solicitaron, ante el Registro Nacional Minero de la Dirección de Geología y Minas, la reserva temporal para un proyecto de cantera para la extracción de materiales sobre esta finca inscrita en la Provincia de Cartago, matrícula Placa19470, descrita en el plano catastrado número Placa19471, para la extracción de brechas y lavas, obtención de piedra quebrada y arena para aprovechar agregados gruesos para los concretos.

Que el 11 de mayo de 2011, Hacienda San Rafael S.A. entregó el formulario para la aprobación del proyecto denominado "Extracción de materiales en cuenca", al cual se le asignó el número de expediente administrativo D1-1573-2011-SETENA, y donde se omitió indicar entre la normativa aplicable, el artículo 11 del Plan Regulador de la Municipalidad de la Unión de Tres Ríos. Que el 5 de setiembre de 2011, se emitió por parte del Geólogo Julio Madrigal Mora de la Comisión Nacional de Emergencia el informe DPM-INF-0852-2011, realizado con el objetivo de obtener un criterio técnico del grado vulnerabilidad del deslizamiento localizado en la margen derecha del río Chiquito, y las amenazas fueron descritas con precisión, emitiéndose las recomendaciones de rigor. Que el 21 de diciembre de 2012, la empresa asesora GEO Tec S.A. entregó ante la Plataforma de Servicio de la Municipalidad de la Unión de Tres Ríos y Nombre3456 respectivamente, el estudio de impacto ambiental del expediente administrativo 1573-2011-SETENA.

Que el 31 de julio del 2013, se emitió la certificación SINAC-D-ACCVC0610-2013 en la cual se indicó: (...) se ha determinado con base en la ubicación consignada en el plano catastrado número C-4022-1969 propiedad de Quebrador San Rafael S. A. con Folio Real 3-065878-000, que este describe un terreno que se ubica fuera de cualquier área silvestre protegida sea cual sea su categoría de manejo administrada por el Ministerio del Ambiente, Energía y MINAE..." Que el 29 de agosto del 2013, mediante resolución 21912013-SETENA, la Comisión Plenaria resolvió otorgar la Viabilidad Ambiental al proyecto denominado "Estabilización de deslizamiento con extracción de cantera" a nombre de la sociedad Hacienda San Rafael H.S.R. S.A., viabilidad con una vigencia de 5 años para el inicio de las obras y con la siguiente descripción: "Consiste en desarrollar la extracción de materiales en cantera, se extraerán brechas y lavas, las cuales serán procesadas con el uso de un quebrador primario, secundario y clasificación mediante cribas.

La fragmentación del material requerirá del uso de explosivos. Se pretende suministrar agregados gruesos y finos para la fabricación de concretos de cementos hidráulicos y asfálticos en la industria de la construcción." Que el área solicitada en concesión es de 19 ha 9050 m2 para un plazo de 15 años, con lo cual se varió el objetivo con el que se iniciaron los trámites, a luz del formulario al que se hizo referencia en el hecho 7 y que fuera presentado para la aprobación del Proyecto denominado "Extracción de materiales en cuenca." Que el 20 de marzo del 2014 la Geóloga Lilliam Anieia Hernández, Coordinadora Minera Región Huetar Norte, mediante el memorándum DGM-CMRC1 /20/2014 emite las siguientes recomendaciones de otorgamiento: "La solicitud es para la explotación de brechas de lava y lavas brechosas para la producción de agregados para la construcción y lastre. De acuerdo al volumen de reservas reportado, se recomienda otorgar la concesión por 15 años con una tasa anual de extracción de 143000 m3." Que el 20 de marzo del 2015, mediante resolución R-083-2015-MINAE, el presidente de la República Luis Guillermo Solís Rivera y la Ministra de Ambiente y Energía Patricia Madrigal Cordero otorgaron a Hacienda San Rafael H.S.R.

S.A. la concesión de explotación de materiales. Que el 7 de julio del 2015 mediante oficio DGM-CMRC 1-61-2015 se comprobó que se estaban realizando trabajos de acondicionamiento, conformación de terrazas, construcción de pilas de sedimentación, construcción de oficinas, previsión de una aguja, entre otras. Que el 13 de agosto del 2015 se emitió la Constancia de uso de suelo, SPPU1110-15-8800701 a solicitud del señor Nombre110780 , para la propiedad con el plano catastrado Placa19467; indicándose entre varias cosas, que la zona es de protección forestal, en el que se permiten los usos forestales, la vivienda unifamiliar, los viveros y las zonas eco turísticas. Que no se permiten usos condicionales y en este documento se hace énfasis que en esta zona no se permite actividad de cantera. Según el artículo 11.b del Reglamento del Plan Regulador Vigente del Cantón de la Unión de Tres Ríos, indicando además que se trata de un terreno con afectación por riesgo potencial de socavamiento de río y con antecedentes de deslizamientos importantes, por lo que deberá solicitarse criterio a la Comisión Nacional de Emergencias.

Que el 18 de noviembre del 2015 se confeccionó la solicitud No. 8803914, donde la empresa "HACIENDA SAN RAFAEL H.S.R. SOCIEDAD ANÓNIMA" con cédula jurídica CED87539, presentó solicitud formal para desarrollar la actividad comercial de Cantera, ante la mencionada Municipalidad, la cual fue recibida por la señorita Angie Vindas, funcionaria de la Plataforma, y se le indicó que no aportaba el uso de suelo ni el permiso de salud. Que el 17 de diciembre del 2015 mediante el oficio MLU-PAT-1790-2015, dirigido a la señora Ana Gabriela González Quirós, el Departamento de Patentes le notifica que debe aportar el Uso de Suelo emitido por la Dirección de Desarrollo y Control Urbano de la Municipalidad de La Unión. Que el 19 de enero del 2016, el Director Jurídico de la Municipalidad de La Unión de Tres Ríos emitió el Oficio número MLU-DJUR-023-2016 en el cual indicó que: "... existe suficiente base normativa y legal para que el concesionario Hacienda San Rafael H.S.R.

S.A.,pueda iniciar sus actividades de explotación pétrea, sin mayor cuestionamiento, amparado al Código de Minería así como a la Ley de Emergencias 8488." Que mediante oficio MLU-DATSAC-0006-2016, el señor Gerardo Morales Barboza, con base en el oficio MLU-DJUR-023-2016 que había dirigido el Lic. Rommel Calvo Padilla a la Licda. Lidia Garita Rodríguez, afirmó que: "Existe suficiente base normativa y legal para que el concesionario Hacienda San Rafael H.S.R. S.A., pueda iniciar sus actividades de explotación pétrea, sin mayor cuestionamiento, amparado al "Código de Minería" así como a la Ley de Emergencias 8488..." Que en el citado Oficio MLU-DATSAC-0006-2016 el Director de Administración Tributaria emite la siguiente orden escrita: "Por lo anterior; siguiendo la instrucción de la Dirección Jurídica se le solicita proceda con el otorgamiento de la Licencia Municipal a Hacienda San Rafael H.S.R.

Sociedad Anónima; toda vez que analizado el caso se determina que no requiere del uso de suelo de la municipalidad, por cuanto prevalece el criterio de la Comisión Nacional de Emergencias como órgano competente y de acatamiento obligatorio." Que el 26 de enero del 2016 el señor Gerardo Morales por medio del oficio MLUPAT-0127- 2016 de la oficina de Patentes de la Municipalidad de la Unión le informó a HACIENDA SAN RAFAEL H.S.R. S.A que su solicitud de Licencia Municipal para ejercer la actividad comercial del TAJO SAN RAFAEL fue aprobada el 26 de enero del 2016, por medio de la RESOLUCIÓN ADMINISTRATIVA correspondiente al número de Licencia Municipal 04717. Que el 9 de febrero de 2016, el Departamento de Auditoria y Seguimiento Ambiental de la Nombre3456 realizó una inspección al lugar del área del proyecto, bajo el Acta de Inspección número Dl-1573-2011-SETENA; se determinó que no había iniciado el proceso de extracción, que carecía del permiso de funcionamiento del Ministerio de Salud, que contaba con la garantía ambiental vigente, y que no se encontraron incumplimientos.

Que el 7 de marzo de 2016 la Dra. Elizabeth González Gamboa del Área Rectora de Salud de la Unión, suscribió el oficio CE-ARS-LU-DA- 256-2016, previniendo la presentación del uso de suelo municipal, para efecto de poder otorgar el permiso de salud para la empresa concesionaria. Que el 11 de mayo de 2016 la Asociación de vecinos de Sierras de la Unión presentó ante el Alcalde actual un recurso extraordinario de revisión contra la resolución que autorizó la patente o Licencia Comercial N° 04-717, y posteriormente interpuso la apelación ante el Tribunal Contencioso Administrativo bajo el expediente 16-007057- 1027-CA -3. Que el 13 de mayo del 2016, la Dra. Elizabeth González Gamboa del Área Rectora de Salud de la Unión de Tres Ríos suscribió el oficio CE-ARS-LU-RS-PSF-20 16 donde aclaró: "No obstante lo anterior, debe señalarse también, que la actividad principal en el sitio va a ser la explotación del tajo que no tiene a la fecha uso de suelo municipal en aval de la actividad.

Por el contrario, consta dentro del expediente conformado para el caso el uso de suelo municipal No. SPPU-1110- 15-8800701 del 13 de agosto del 2015, donde se indica que la zona no permite actividad de cantera. Siendo que mi deber es acatar la Ley General de Salud en toda su amplitud, los artículos 298, 299, 300, 301 y 304 de la Ley General de Salud, son muy claros al establecer que la actividad de cantera es una actividad industrial que requiere de permiso sanitario de funcionamiento para poder operar. Al ser esta una actividad industrial que incluye trabajo de maquinaria, instalación de quebradores y otros que pueden degradar la calidad del entorno y amenazar la salud de los pobladores; el Ministerio de Salud debe dar la autorización previa a la operación y luego ejercer la vigilancia debida para garantizar que todo trascurra (sic) con normalidad. Es claro entonces, que no puede la suscrita autorizar el permiso de funcionamiento solicitado para ejercer en el sitio: "Actividades de apoyo para otras actividades de minas y canteras", cuando la actividad principal de explotación de tajo, carece de los permisos y/o autorizaciones del Ministerio de Salud." Que al día de hoy, el proyecto minero en el sector de Las Cazuelas no cuenta con Uso de Suelo Conforme, ningún permiso del Ministerio de Salud, ni con declaratoria de Conveniencia Nacional.

Que al día de hoy, la Municipalidad de la Unión no ha instalado los dispositivos GPS, ni existen cámaras, ni pluviómetros que permitan monitorear dicho terreno. Tampoco se han elaborado los mapas de vulnerabilidad, para prevenir una potencial avalancha provocada por el taponamiento del Río Chiquito, cuyo origen sería el derrumbe en el sector de Las Cazuelas. FUNDAMENTOS (MOTIVOS DE NULIDAD): I) IRRESPETO DEL PRINCIPIO DE INDEROGABILIDAD SINGULAR DEL

REGLAMENTO. Que existe claridad en que pese a la letra del artículo 15 de la Ley de Planificación Urbana otorga a las municipalidades potestades para determinar los usos de suelo, por medio de los planes reguladores y otras reglamentaciones, dentro del territorio bajo su jurisdicción, es en este caso la propia Municipalidad de la Unión de Tres Ríos, el ente que irrespeta las estipulaciones del artículo 11.b de su Plan Regulador, otorgando una patente comercial para la explotación de un tajo o cantera, en una zona que es exclusivamente de protección forestal, con los únicos usos: forestales, de vivienda unifamiliar, de viveros y zonas eco turísticas, con lo cual se violenta así el principio de inderogabilidad singular del reglamento. II) IRRESPETO DEL PRINCIPIO DE LEGALIDAD CON EL OTORGAMIENTO DE LA PATENTE MUNICIPAL. Que los funcionarios que autorizan o avalan el otorgamiento de la Patente Comercial, pretenden sustentar que el uso de Suelo Municipal está dado por el oficio DST-004-14 antes mencionado, bajo el amparo de la Ley No. 7779, de Uso, Manejo y Conservación de Suelos, situación que es un absurdo, pues si bien la ley tiene las palabras Uso y Suelo, su aplicabilidad es para determinar la capacidad de los terrenos desde una perspectiva netamente agrícola, y no tiene ninguna relación con el Uso de Suelo Municipal.

Que así, la pretensión de sustentar el permiso municipal de la patente otorgada, violenta el artículo 28 de la Ley de Planificación Urbana cuyo texto dice literalmente: "Prohíbase aprovechar o dedicar terrenos, edificios, estructuras, a cualquier uso que sea incompatible con la zonificación implantada". III) LA FALTA DE MOTIVO LEGÍTIMO RESPECTO DE LA FALTA DE CERTIFICACIÓN DE USO DEL SUELO. Que no es válido indicar que el motivo del acto para la patente municipal en el tema del Uso de Suelo Municipal, está dado por la certificación del INTA, si los propios funcionarios municipales conocen que el 14 de mayo del 2003 se publicó en La Gaceta No. 91, el Plan Regulador de la Municipalidad de la Unión de Tres Ríos, el cual determinó que la zona donde se ubica la finca No. 65878 propiedad de Hacienda San Rafael H.S.R. S.A. es de protección forestal, en el que se permite los usos forestales, la vivienda unifamiliar, los viveros, y las zonas eco turísticas.

Que no se permiten usos condicionales y donde NO se permite actividad de cantera, por lo que es claro que este permiso municipal no cuenta con un motivo legítimo respecto del Plan Regulador Municipal. IV) IRRESPETO DEL PRINCIPIO DE LEGALIDAD AL OTORGAR LA PATENTE MUNICIPAL SIN PERMISOS DE SALUD. Que se nota la ilegalidad en que se incurrió con el otorgamiento el otorgamiento de la Patente Municipal 04-717 en enero del 2016, si para mayo de ese año, todavía no había ningún permiso de salud aprobado en total irrespeto al artículo 299 de la Ley General de Salud que literalmente dispone: "Ninguna autoridad podrá conceder patentes o permisos para el funcionamiento de establecimientos industriales sin que medie la previa autorización de funcionamiento del Ministerio." V) IRRESPETO DEL PRINCIPIO DE LEGALIDAD POR CONSTRUCCIÓN DE OBRAS SIN PERMISOS. Que el 7 de julio del 2015 mediante oficio DGM-CMRC 1-61-2015 se comprobó que se estaban realizando trabajos de acondicionamiento, conformación de terrazas, construcción de pilas de sedimentación, construcción de oficinas, previsión de una aguja, entre otras.

Que llama la atención como para junio del 2015 se constatan labores de estabilización de taludes, caminos terminados, oficinas y baños casi listos, si para el 13 de agosto del 2015 se emitió la Constancia de Uso de Suelo SPPU-1110-15-8800701, solicitada por el señor Nombre110780 para la propiedad con el plano catastrado Placa19467. Que así las cosas, al no tener los permisos de construcción a derecho, procede la aplicación del artículo 18 de la Ley de Construcciones que reza: "Quien hiciere construcciones o reconstrucciones sin el permiso Municipal, además de pagar la multa prescrita por el Reglamento de Policía, será obligado a demoler lo construido." VI) IRRESPETO DEL PRINCIPIO DE LEGALIDAD EN TRÁMITE DE LA VIABILIDAD AMBIENTAL. Que entre la normativa ambiental aplicable a este caso, encontramos el Plan Regulador de la Municipalidad demandada, del 14 de mayo del 2003, en el cual se indica que la zona donde se ubica la finca MATRICULA Placa19472, propiedad de Hacienda San Rafael H.S.R.

S.A. es de protección forestal, en la que se permite los usos forestales, la vivienda unifamiliar, los viveros, y las zonas eco turísticas. Que no se permiten usos condicionales y donde NO se permite actividad de Cantera. Que es notorio el hecho de que la Nombre3456 nunca valoró que el Plan Regulador de la Municipalidad demandada no permitía, en dicho lugar, la operación o funcionamiento de una Cantera o Tajo, y se dio un flagrante incumplimiento del inciso c) del artículo primero de la Guía para el llenado del Documento de Evaluación Ambiental D-1, del anexo 2 del decreto N 32712-MINAE que indica: 'La omisión de información solicitada en el formulario conforme el Decreto Ejecutivo No. 31849 o la falta de algunos o documentos adicionales a presentar, hará que se califique el documento como incompleto y se rechace el mismo de forma total." VII) IRRESPETO A LAS REGLAS DE LA CIENCIA Y LA TÉCNICA Y AL PRINCIPIO PRECAUTORIO EN EL OTORGAMIENTO DE LA VIABILIDAD AMBIENTAL.

Que para la emisión de la resolución 21912013-SETENA que otorgó la Viabilidad Ambiental, la Nombre3456 debió de razonar en la resolución la conformidad de las medidas de mitigación ambiental con los principios de la ciencia y la técnica, a efecto de garantizar que la resolución respetara los principios de lógica y conveniencia para la comunidad. Lo que a su juicio no hizo, con el riesgo de incremento de deslizamientos por explosiones y pendientes inclinadas, como tampoco con lo relativo a la generación de polvo, al transporte de material y el uso de maquinaria pesada. VIII) VIOLACIÓN AL PRINCIPIO DE PARTICIPACIÓN CIUDADANA EN EL TRAMITE DE LA VIABILIDAD AMBIENTAL. Que la resolución 2191-2013-SETENA que otorgó la Viabilidad Ambiental de Nombre3456 a este proyecto, no tomó en cuenta la existencia de muchas ciudades: una urbanización de más de 200 casas de habitación, varios conjuntos de apartamentos y condominios de la Carpintera, Estancia Antigua como las más cercanas, que serán muy afectadas por la operación del tajo.

Que tampoco fue tomada en cuenta por Nombre3456 la ciudad de Yerbabuena, que sólo aparece como un caserío, pero que y ahora tiene escuelas, colegios y cooperativa. IX) EL VICIO DE DESVIACIÓN DE PODER EN EL OTORGAMIENTO DE LA VIABILIDAD AMBIENTAL Y LA LICENCIA MUNICIPAL. Que si se ve con detenimiento, nos podremos percatar que el área de riesgo de derrumbe es el propio talud de 15 metros de alto, con un área aproximada de 400 metros, pero la concesión otorgada a la empresa Hacienda San Rafael H.S.R. S.A., mediante resolución R-083-2015 lo es para explotar 11 ha 4519 m2 por un plazo de 15 años. Que es claro, que si la verdadera necesidad para otorgar la concesión minera fuera minimizar el riesgo, se habría hecho una concesión exclusivamente para estabilizar o eliminar el talud que podría derrumbarse, para así no generar una afectación mayor al medio ambiente, pero es evidente que aprovechándose de la situación de riesgo y de los dictámenes de la CNE, pretenden burlar la regulación establecida por el Plan Regulador de la Municipalidad de la Unión, que como dijimos supra, no autoriza las actividades de cantera, sino mas bien actividades de conservación.

Que es menester indicar además, que siquiera la CNE tiene certeza si la mejor opción es intervenir el deslizamiento, o mas bien la mejor alternativa es no tocarlo, pues siquiera se le han dado los estudios que justifiquen la intervención del mismo. X) NULIDAD DE LA CONCESIÓN Y LA PATENTE MUNICIPAL POR IRRESPETO AL INTERÉS PÚBLICO. Que en el presente caso, podemos observar con preocupación como los funcionarios de la Municipalidad demandada, la Nombre3456 y la Dirección de Geología y Minas, pretenden justificar un Interés Público de otorgamiento de una concesión minera, por un riesgo a la población, pero cuando vamos a ver el área de riesgo de derrumbe, ésta es de menos de mil metros cuadrados, pero con ese riesgo, otorgamos una concesión para un área concesionada de explotación de material de 15.519 m2 por un plazo de 15 años de concesión, siendo más que evidente que al final se está utilizando la figura del riesgo inminente, para intentar brincarse la regulación dada por el Plan Regulador de la Municipalidad de la Unión de Tres Ríos y la Ley Forestal.

Que se reitera el hecho de que ni siquiera la CNE tiene certeza si la mejor opción es intervenir el deslizamiento, o al contrario, la mejor alternativa es no tocarlo, pues hasta el momento, no existen estudios que justifiquen la intervención del mismo. XI) LA VIOLACIÓN DEL PRINCIPIO DE RAZONABILIDAD Y PROPORCIONALIDAD. Que se insiste en esta demanda, sobre la pretensión de la Municipalidad demandada, la Nombre3456 y la Dirección de Geología y Minas de hacer creer que el problema del deslizamiento en el sector de Las Cazuelas se resolverá con el otorgamiento de una concesión minera de un área de 15.519 m2 por un plazo de 15 años, pero cuando se ve el área de riesgo de derrumbe, es de menos de mil metros cuadrados, de tal modo que es evidente que la medida propuesta, no es proporcional ni racional, máxime si tomamos en cuenta, que con esa concesión se justifica la violación del Plan Regulador de la Municipalidad de la Unión de Tres Ríos, pues en dicho lugar no se autorizan, por el Plan regulador vigente de esa Municipalidad, las canteras como usos permitidos.

Que adicionalmente no queda claro cómo ante una situación de riesgo inminente, donde la intervención debería ser en la forma más rápida posible, se aprueba al contrario, una concesión para una explotación de 15 años, plazo que es absurdamente extenso para atender un talud con riesgo de deslizamiento casi inminente. XII) AUSENCIA DE DECRETO DE CONVENIENCIA NACIONAL Y FALTA DE PERMISOS DE TALA. Que en el artículo 34 de la Ley Forestal se prohíbe la corta o eliminación de árboles en las áreas de protección descritas en el ordinal 33 de dicho cuerpo normativo, excepto en proyectos declarados por el Poder Ejecutivo como de conveniencia nacional. Que aunque es claro que en dicho sector es un área de protección del Río Chiquito, y en los cuales existen árboles que podrían caer al cauce, es claro que para poder talar dichos árboles, es necesario entonces que de previo a la tala, se realice un decreto de declaración de conveniencia nacional por el Poder Ejecutivo; lo que obligaría a la realización previa de estudios serios para poder justificar el decreto en donde se pueda determinar si es mejor intervenir el sector para prevenir un derrumbe mayor, o es mejor dejar el sitio sin intervención, para no inestabilizar más el sitio, y acelerar y magnificar el problema.

Que conforme a la información que consta en los expedientes administrativos de la Municipalidad, no se aprecia que se hubiere solicitado este permiso de tala. HACIENDA SAN RAFAEL H.S.R. S.A: I) Que de conformidad con lo dispuesto por el artículo 11.b del Plan Regulador, se establece que los proyectos en zona forestal están sujetos a un estudio de impacto ambiental para su aprobación. Que siendo así, de aprobarse el estudio de impacto ambiental no puede presumirse una conculcación al ordenamiento jurídico ni a los principios que integran la actuación administrativa. Que dicho estudio de impacto ambiental fue efectivamente concedido al proyecto por medio de la resolución No. 2191-2013-SETENA, de las 8:15 horas del 29 de agosto del 2013. II) Que además de no poderse demostrar la conculcación al Principio de Legalidad, porque es claro que los oficios No. DGM-RNM-9852015.DST-004-14 y MLU-DIUR-023-2016 acreditan el cumplimiento de la Administración a lo dispuesto en lo numerales 11 y 16 de la Ley General de la Administración Pública, es lo cierto que no existe la nulidad por la nulidad misma, sin que en la especie se haya probado perjuicio o indefensión alguna.

  • III)Que en este mismo punto la parte actora se contradice, dado que como ella misma indica en el oficio DGM-RNM-985-2015 se aclaran las dudas de la auditora interna sobre el estudio de uso de suelo, en el cual se afirma que no es necesaria la presentación del uso de suelo aprobado por la Municipalidad del lugar donde se ubica el área solicitada, siendo necesario únicamente, un estudio de uso conforme de suelo por parte del Instituto Nacional de Innovación y Transferencia Tecnológica Agropecuaria, el cual se presentó mediante el oficio DST-004-14, por lo cual dicho argumento carece de validez. IV) Que no existe conculcación al principio de legalidad en el caso concreto, porque si bien se cuenta con la autorización para ejercer la actividad comercial de tajo, según el oficio No. MLU-PAT-0127-2016 y la licencia municipal No. 04-17, al que hace referencia la parte actora, lo cierto es que dicha actividad no ha sido explotada y se encuentran paralizadas todas las actividades respecto a esta actividad comercial, a falta de que se emitido el permiso respectivo.
  • V)Que en cuanto a este apartado, las consideraciones fácticas y jurídicas indicadas por la parte actora no son suficientes para que aún de prosperar el reclamo, esta instancia jurisdiccional ordene la nulidad de los actos administrativos declaratorios de derechos subjetivos emitidos a su favor. VI) Que en el caso concreto, el otorgamiento de la viabilidad ambiental del proyecto por medio de la resolución N° 2191-2013-SETENA, se dio conforme a las reglas y principios que establecen los artículos 11 y 16 de la Ley General de la Administración Pública y la parte actora no logra desacreditar desde el punto de vista técnico y científico, ni en forma razonada tales estudios de viabilidad, aportando los dictámenes y estudios emitidos por profesionales calificados en la materia que se discute. Que por otro lado no es cierto, como ya fue explicado anteriormente que existe quebranto alguno al Plan Regulador.
  • VII)Que la parte actora utiliza una serie de datos sacados de contexto, pues no logra establecer con claridad, como los elementos mencionados se adhieren al caso en concreto. Que por ello carece de conexidad, lo cual queda claro con el uso como ejemplo de un país como China, que no cuenta con las características geográficas, ni siquiera similares a la zona en cuestión, por lo que es un absurdo considerar que lo ocurrido en algunas zonas de este país asiático van a darse en nuestro territorio, per se. Que tal y como se indicó, pese a que se ataca la viabilidad ambiental otorgada por SETENA, la parte actora no aporta los elementos periciales necesarios que sustenten su postura, no siendo procedente hacer afirmaciones que no cuentan con el sustento técnico requerido. VIII) Que carece de razón indicar que la viabilidad ambiental es nula en virtud de que no se contó con la participación ciudadana en el trámite, pues como se indica en los alegatos de la parte accionante, por parte de Nombre3456 se realizó la convocatoria a la ciudadanía y el expediente bajo el cual se tramita el informe de viabilidad ambiental es de carácter público, tal y como lo establece la ley.

Expediente respecto del cual, en ningún momento se es negó el acceso al mismo, ni la posibilidad de realizar alguna observación o la defensa de sus derechos por los medios legalmente establecidos. IX) Que dichas afirmaciones son juicios de valor emitidos sin fundamento alguno, ya que en el caso concreto no presentan ninguna probanza técnica o científica que indique que lo actuado no cumple con el fin principal. X) Que en el informe DPM-INF-0852-2011, el Geólogo Juan Madrigal Mora, indica que de conformidad con la visita realizada queda en evidencia que en un corto plazo se podrían producir obstrucciones como consecuencia de la caída de material lo cual podría ocasionar daños graves a los vecinos y otras estructuras importantes de la zona. Que por su parte, la Dirección de Geología y Minas, mediante el oficio DGM-RNlM-985-2015, señaló que la concesión minera podría solventar y evitar consecuencias de un deslizamiento, lo cual podría prevenir un taponamiento en el río.

Que es en virtud de lo anterior, del peligro que constituye para los vecinos, de las consecuencias que podrían generarse a raíz de su desatención y de las facultades jurídicas y técnicas mencionadas, que la Administración decide aprobar el permiso en cuestión. XI) Que la parte actora nos quiere hacer creer que no se cumple con los requisitos y que el plazo otorgado para la zona otorgada no cumplen con la Razonabilidad y la Proporcionalidad, pero la parte actora no aporta prueba alguna que fundamente sus alegatos, no adjunta ningún documento que indique que lo otorgado no cumple con los elementos de la Razonabilidad o que los mismo no son Proporcionales. Que si se otorgó la Concesión Minera fue a través de criterios técnicos, respaldado por una serie de Oficios que mencionan que es idónea, necesario y proporcional. XII) Que la parte demandante menciona que no se cuenta con un Decreto de conveniencia nacional y tampoco se cuenta con un permiso de tala de árboles, pero es claro que no se cuenta con ello, por cuanto en ningún momento pretende realizar dicha actividad de tala de árboles o el aprovechamiento forestal.

Que como consta en la Resolución R-083-2015-MINAE, los únicos trabajos que se pretenden realizar en la zona para la cual se otorgó la Concesión, sería la extracción de materiales de una cantera, materiales que serían brechas de lava y lava brechosas. Que en ningún momento se pretende manipular o realizar la tala de árboles o el aprovechamiento forestal. Que por tal razón lo dicho por la accionante no debe ser considerado, ya que no viene al tema por ser una actividad que no se pretende realizar y no se ha realizado por lo que la falta de permiso de tala y la ausencia de un Decreto Nacional no son necesarios para una actividad que no se ha realizado. MUNICIPALIDAD DE LA UNIÓN: Después de transcribir oficios de diversas instituciones, indica que a manera de conclusión debe considerarse lo siguiente:

  • 1)Que existe informe del Geólogo Julio Madrigal Mora DRM-INF-0852-2011 sobre el peligro eminente del deslizamiento sobre el río Chiquito.
  • 2)Que existe aval de Nombre3456 mediante la resolución 2191-2013 SETENA.
  • 3)Que el INTA mediante resolución DSF004-2014 da el aval para dicha actividad.
  • 4)Que mediante DGM-RNM-834-2017 se da la Concesión de Extracción de Materiales a favor de Hacienda San Rafael.
  • 5)Que se cuenta con el Voto de la Sala Constitucional bajo el Expediente: 16-004105-0007- CO.
  • 6)Que siguiendo ese orden de ideas, también es de importancia la Sentencia No. 10297-2016 de la Sala Constitucional.
  • 7)Que mediante resoluciones MLU-DJUR-023--2016 dando criterio jurídico y resolución MLU-DA TSAC-00062016 dando esta última el aval para la respectiva licencia comercial la Municipalidad de la Unión dio la autorización para dicha actividad. ESTADO: Que concretamente, por lo que se refiere a los actos del Estado, con este proceso judicial se pretende anular la resolución No. 2191-2013-SETENA, que le otorgó la viabilidad ambiental al proyecto de explotación de cantera a favor de la sociedad codemandada Hacienda San Rafael H.S.R. S.A. y la resolución del Poder Ejecutivo No. R-083-2015-MINAE, que le confirió la respectiva concesión. Que la demanda en los términos expuestos resulta improcedente por cuanto carece de todo fundamento jurídico y probatorio. Que en ese sentido, la actora evidencia un desconocimiento de la normativa aplicable a los actos impugnados y por consiguiente, de las mismas competencias que tienen atribuidas por ley la Nombre3456 y la Dirección de Geología y Minas. Que en esta línea, ha de notarse por ejemplo, que a lo largo del escrito de demanda no se hace mención siquiera a una norma tan elemental para el caso de marras como lo es el Código de Minería, cuyo artículo de entrada: "declara de utilidad pública toda la actividad minera, tanto en los trabajos de exploración, como en los de explotación. Tendrán el mismo carácter la concentración, beneficio, transformación, transporte de sustancias minerales y los terrenos de propiedad particular o estatales necesarios para estos fines." Que así las cosas, el propio legislador es el que considera de utilidad pública la extracción de materiales al igual que su transporte, incluso por terrenos de propiedad particular, lo que la hace una actividad lícita. Que por tal razón, el Poder Ejecutivo no necesita valerse de subterfugios -que para la actora consistiría en la atención de un riesgo inminente a la población- para justificar el interés público inherente en la concesión otorgada a la empresa codemandada a través de la resolución No. R-083-2015-MINAE. Que del estudio de sendos expedientes administrativos se desprende que Nombre3456 y la Dirección de Geología y Minas concibieron desde un inicio del procedimiento que la solicitud de la empresa codemandada tiene un fin evidentemente comercial de explotar la cantera. Lo que explica el plazo y el área otorgada en concesión a tono con lo dispuesto en el Código de Minería - que tanta extrañeza le causa a la demandante - no para resolver un problema puntual de deslizamiento, sino para garantizar que el proyecto concesionado sea factible. Que esto implica que ninguna de esas dos dependencias administrativas se basó en la figura del riesgo inminente para tratar de burlar los requisitos establecidos por el ordenamiento jurídico para la emisión de los actos impugnados, aún menos, intentaron asustar a la población con ese propósito, como temerariamente se afirma por la Asociación actora. Que tal y como quedó demostrado de la contestación a los hechos de esta acción - en especial, la de los hechos 11 y 17- la Nombre3456 y la Dirección de Geología y Minas observaron fielmente los requisitos establecidos en el Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA) 31849-MINAE-S-MOPT-MAG-MEIC del 24 de mayo del 2004- el Código de Minería y su reglamento, al igual que cada una de las etapas del procedimiento previstas por la normativa citada para la emisión de los actos impugnados. Que incluso del Estudio de Impacto Ambiental elaborado por la empresa codemandada se desprende el proceso de consulta a la comunidad con participación del Concejo Municipal de La Unión y según se indicó en la contestación al hecho noveno de la acción, en el expediente administrativo se demuestra la publicación en un diario de circulación nacional avisando de la presentación de dicho estudio, con una descripción del proyecto de concesión en cuestión, sin que conste que la actora o cualquier otro interesado dentro del plazo de 10 días conferido haya manifestado su oposición. Que de igual forma, en respeto del principio de publicidad y transparencia, durante el trámite seguido para el otorgamiento de la concesión minera consta en el expediente No. 2754, tal y como se indicó en la contestación al hecho 17 de la acción, la publicación del edicto dando aviso del proyecto de concesión para extracción de materiales solicitado por la empresa codemandada los días 6 y 10 de junio del 2014 en La Gaceta, sin que dentro de los quince días hábiles ulteriores a la última publicación se haya presentado objeción alguna por parte de la asociación actora o de cualquier otro interesado. Siendo que, el trámite que echa de menos la demandante no se establece como un requisito esencial que determine la invalidez de los actos impugnados. Que se insiste que no es competencia de la Nombre3456 determinar el uso conforme del suelo para el desarrollo de una determinada actividad, pues a tenor del artículo 28 de la Ley de Planificación Urbana (No. 4240), tal obligación recae en la municipalidad respectiva, concretamente, en el ente territorial aquí codemandado. Que la parte actora desconoce la naturaleza instrumental de la licencia ambiental, en cuya virtud, el beneficiario de dicho acto debe a su vez cumplir con la carga de recabar el resto de permisos que resulten pertinentes para el desarrollo de su actividad. Que ello se puede constatar, al revisar la definición de Estudio de Impacto Ambiental que nos da el Código de Minería en su artículo 2° y otro normativa conexa -la cual cita-. Que del carácter instrumental de la Viabilidad (Licencia) Ambiental otorgada mediante la citada resolución 2191-2013-SETENA, se deriva que dicho acto no exime a su destinatario de recabar el resto de permisos de las autoridades competentes que son exigidos por el ordenamiento jurídico para poder desarrollar la actividad de explotación de cantera. Que prueba de ello es que aún contando con la licencia ambiental, la empresa codemandada no ha podido iniciar operaciones al carecer del permiso sanitario de funcionamiento. Que de igual forma, en lo referente a la concesión otorgada mediante la resolución No. R-083-2015-MINAE, el propio artículo 12 del Código de Minería advierte del alcance limitado de dicho título habilitante, debiendo cumplir el concesionario con el resto de requisitos que establece el ordenamiento para poder dar inicio a las labores de extracción. Que aún más relevante es que ni el artículo 25 del Código de Minería (Ley No. 6797 del 4 de octubre de 1982), ni el artículo 24 de su Reglamento exigen el permiso de uso de suelo por parte de la Municipalidad respectiva como requisito para otorgar la concesión minera. Que tal y como se señaló en la contestación al hecho 13 de la acción, el Estudio de Uso Conforme del Suelo avalado por el INTA efectivamente consta que fue aportado al expediente No. 2754. Que en consecuencia, durante la tramitación de los dos actos impugnados -de interés para el Estado- no se incurrió en omisión alguna por parte de la Nombre3456 o la Dirección de Geología y Minas. Que la parte actora cuestiona aspectos estrictamente técnicos relacionados con la intervención en la margen derecha del Río Chiquito y las medidas de mitigación aprobadas en la licencia ambiental. Que sin embargo, lo hace a partir de meras conjeturas o especulaciones sin ningún tipo de fundamento técnico. Que cuando lo cierto es que tanto la SETENA, como la Dirección de Geología y Minas, al momento de analizar la gestión de la empresa codemandada, tomaron muy en cuenta la alta inestabilidad de la zona del proyecto y la situación de vulnerabilidad existente, con fundamento en las conclusiones arrojadas por el informe No. DPM-INF-0852-2011 de la CNE que para ese momento era el criterio técnico más reciente que sobre el particular se había emitido por dicho órgano -; por lo que siempre desde un punto de vista técnico y científico, como se terminará de corroborar con la declaración del funcionario Chavarría Camacho ofrecido dentro del apartado de prueba, ambas oficinas determinaron que la explotación de la Cantera, al tiempo que cumplía con los fines propios de este tipo de actividades, podía servir como una medida para mitigar el riesgo de represamiento del río Chiquito y contribuir a la estabilización del macizo de tierra. Que de hecho se valoró como parte de la factibilidad del proyecto el incentivo para la concesionaria en explotar comercialmente la cantera, pues así se estaría financiando por su cuenta las labores de mantenimiento y de limpieza del cauce. Que incluso no existe contradicción entre lo dispuesto en ese primer informe de la CNE y el otorgamiento de los actos impugnados. Y que como consta del mismo expediente No. 2754, según se indicó en la contestación al hecho 25 de esta acción, se ha dado una coordinación efectiva entre los funcionarios de la CNE y la Dirección de Geología y Minas. Que de hecho el seguimiento y monitoreo al área concesionada se ha mantenido a la fecha por parte de la referida Dirección, como así lo corroborará el testigo ofrecido Chavarría Camacho.

IV. DEL FUNDAMENTO DE LA DEMANDA Y SU VALORACIÓN POR PARTE DE ESTE TRIBUNAL

Tal y como puede apreciarse de una simple lectura de la demanda y contestaciones de los codemandados, quien acciona aduce como parte de su Teoría del Caso, la existencia de una serie de vicios en las conductas formales que ataca, dividiendo los mismos en diversos apartados -12 para ser exactos-, mismos que titula de la siguiente forma:

  • i)Irrespeto del Principio de Inderogabilidad Singular del Reglamento. ii) Irrespeto del Principio de Legalidad con el otorgamiento de la Patente Municipal. iii) La falta de motivo legítimo respecto de la falta de certificación de uso del suelo. iv) Irrespeto del Principio de Legalidad al otorgar la Patente Municipal sin permisos de salud. v) Irrespeto del Principio de Legalidad por construcción de obras sin permisos. vi) Irrespeto del Principio de Legalidad en trámite de la Viabilidad Ambiental. vii) Irrespeto a las reglas de la ciencia y la técnica y al Principio Precautorio en el otorgamiento de la Viabilidad Ambiental. viii) Violación al Principio de Participación Ciudadana en el tramite de la Viabilidad Ambiental. ix) El vicio de desviación de poder en el otorgamiento de la Viabilidad Ambiental y la Licencia Municipal. x) Nulidad de la Concesión y la Patente Municipal por irrespeto al interés público. xi) La violación del Principio de Razonabilidad y Proporcionalidad. xii) Ausencia de Decreto de Conveniencia Nacional y falta de permisos de tala.

Así estructurada la línea argumentativa de quien demanda respecto de los motivos de nulidad, puede observarse con absoluta claridad que los primeros cinco se refieren a lo actuado por la Municipalidad, el sexto, sétimo y octavo, se encuentran dirigidos a la Viabilidad Ambiental, el noveno tanto a la Viabilidad dicha como a la Licencia Municipal, el décimo se encuentra referenciado a la Concesión y Licencia Municipal y por último, el undécimo y duodécimo se dirigen a atacar la Concesión solamente. Siendo ello así, en aras de respetar el orden en que han sido desarrollados los argumentos dichos, esta Cámara analizará los mismos respetando la numeración y temática de cada uno, sin perjuicio de agrupar varios de ellos -cuando por el tema sea posible- a efecto de analizarlos de manera conjunta. Señalado lo anterior, respecto de lo actuado por el Gobierno Local demandado, se aprecia que el primero de ellos es el relacionado con el quebranto al Principio de Inderogabilidad de las Normas, que estima lesionado la demandante en tanto en su criterio, la Municipalidad de la Unión inaplicó para el caso concreto, el ordinal 11.b del Plan Regulador.

Siendo este aspecto medular en el caso bajo estudio y de paso encontrarse como primero en la línea argumentativa de la Asociación accionante, será sobre el mismo que se pronunciará acto seguido esta Cámara, en el entendido de que en el supuesto de acogerse tal reparo, lógicamente por el efecto que ello tendría sobre las actuaciones municipales cuestionadas, sería innecesario pronunciarse sobre los demás argumentos esgrimidos contra las mismas en los restantes apartados. Precisado lo anterior, respecto del primer quebranto aducido por la demandante, debemos recordar lo que expresamente establece el ordinal 13 de la Ley General de la Administración Pública sobre el Principio de comentario:

"1. La Administración estará sujeta, en general, a todas las normas escritas y no escritas del ordenamiento administrativo, y al derecho privado supletorio del mismo, sin poder derogarlos ni desaplicarlos para casos concretos.

2. La regla anterior se aplicará también en relación con los reglamentos, sea que éstos provengan de la misma autoridad, sea que provengan de otra superior o inferior competente." La norma es absolutamente clara, la Administración Pública tiene vedado desaplicar para casos concretos -manifestación del Principio constitucional de Igualdad-, tanto las normas escritas como las no escritas -TODAS-, haciéndose expresa mención que ello aplica también para las disposiciones reglamentarias. Aunque bien podría decirse que el segundo apartado era innecesario porque en el primero no dejaba margen alguno de duda en tanto expresamente hace referencia a TODAS las normas escritas y no escritas, el legislador no lo consideró así y decidió sepultar cualquier espacio a la interpretación o discrecionalidad. Y es que este principio constituye una garantía complementaria para el ciudadano, como una extensión del principio de legalidad (art.11 de la C.P. y 11 de la LGAP), el cual manda a que la Administración solamente puede desplegar o autorizar aquellas conductas previamente autorizadas por ley, y que en todo caso, no podrá desaplicar o derogar el ordenamiento jurídico en general para un caso concreto. En este sentido, la Sala Constitucional señaló en su Sentencia No. 398-2005 de las doce horas con diez minutos del veintiuno de enero del dos mil cinco, que:

"En efecto, la inderogabilidad singular de los reglamentos administrativos surgió como un instituto para garantizar que una norma administrativa de alcance general y abstracto, no sea excepcionada o desaplicada casuísticamente, esto es, para determinados casos particulares, todo en resguardo del principio constitucional de la igualdad de los destinatarios -efectos externos- frente a la misma (artículo 33 de la Constitución Política)." Dicho lo anterior, sea, establecida la forma en que se encuentra regulado el referido Principio y además, cómo debe aplicarse el mismo, seguidamente se transcribe completo el numeral 11 del Plan Regulador del Cantón de la Unión, que la Asociación actora estima quebrantado en su inciso b):

"Artículo 11.-Zona de protección forestal:

  • a)Propósitos. Esta zona es necesaria para retener el desarrollo urbano y continúan en ella el uso forestal.
  • b)Usos permitidos:

Forestales De acuerdo al artículo 48, capítulo I de la Ley Forestal y sus Modificaciones, se aplica para los efectos de este Plan lo siguiente:

"Artículo 48.-Los terrenos forestales y bosques de propiedad privada incluidos en una reserva forestal o zona protectora, deberán utilizarse de acuerdo con el respectivo plan de manejo. Sus propietarios tendrán derecho a gozar de los beneficios e incentivos que fija la presente Ley. Asimismo, los dueños de estas tierras, deberán ajustarse a lo expuesto en los artículos 60 al 65 de la sección II, capítulo 1, del aprovechamiento del recurso forestal en terrenos de propiedad privada de la Ley Forestal.

Vivienda unifamiliar con características suburbanas, quedan excluidos en todo caso los conjuntos residenciales y las urbanizaciones de cualquier tipo.

Viveros Zonas ecoturísticas c) Usos condicionales. No se permitirán usos condicionales.

  • d)Requisitos. En la zona norte (Zurquí) y sur (Carpintera), se aplicarán los requisitos del artículo 5º del reglamento GAM.

Superficie mínima 10 Ha. en zona norte a partir de la Dirección3536 y 5 Ha. zona sur con la misma referencia.

Frente mínimo del lote 50 metros.

Retiros Frontal 20 metros Lateral 5 metros Posterior 5 metros Cobertura máxima el 10% del lote.

Área máxima de piso 10% del área del lote.

Los proyectos en esta zona están sujetos a un estudio de impacto ambiental." La disposición normativa recién transcrita, es prístina en cuanto a los usos permitidos: forestales, vivienda unifamiliar, viveros y zonas ecoturísticas. Luego, indica la referida norma que no están permitidos los usos condicionales y que los proyectos -debe entenderse que los permitidos- estarán sujetos a un estudio de impacto ambiental. Se hace expresa referencia a proyectos permitidos en esa zona, pues de estimarse lo contrario -como parece hacerlo la empresa accionada-, sea que cualquier proyecto mientras cuente con un estudio de impacto ambiental puede desarrollarse en la misma, se vaciaría de contenido la norma bajo análisis y tornaría en absurda la lista de los usos permitidos y por supuesto la prohibición de usos condicionales. De hecho en tal supuesto -sea como parece entenderlo la sociedad codemandada-, hubiere bastado que el ordinal indicara que además de los usos permitidos, todo proyecto que cuente con estudio de impacto ambiental se encuentra permitido en esa zona.

O bien que la norma dijera que además de los usos expresamente permitidos, se considerarían como tales -porque los condicionales se prohibieron de forma expresa- aquellos que fuera de esta lista taxativa, contaran con un estudio de impacto ambiental. Entonces, se podría establecer la diferencia entre proyectos permitidos que no requerirían de estudio de impacto ambiental de los también permitidos por contar con estudio de impacto ambiental. Lo que sería un despropósito regulatorio en materia de Planes Reguladores, porque finalmente no regularía nada respecto del uso de suelo. Todo se podría hacer -entiéndase desarrollar-. De hecho, obsérvese que la propia Municipalidad accionada lo entiende como esta Cámara, en tanto al resolver la gestión de Certificado de Uso de Suelo, de forma clara y precisa el Arquitecto José Carlos Barrantes Cubillo, en su condición de Coordinador de Planificación Urbana de la entidad Municipal accionada, señaló -hecho probado No. 7- que:

"SOLICITANTE: Nombre110780 . PLANO DE CATASTRO: Placa19467. ZONA:

ZONA DE PROTECCIÓN FORESTAL. USO: CONSULTA. ACTIVIDAD: INFORMATIVO.

Zona de Protección Forestal: Propósitos. Esta zona es necesaria para retener el desarrollo urbano y continúan en ella el uso forestal. 4. Usos permitidos: 1. Forestales. 5. (sic) Vivienda unifamiliar con características suburbanas, quedan excluidos en todo caso los conjuntos residenciales y las urbanizaciones de cualquier tipo. 6. (sic) Viveros. 4. (sic) Zonas ecoturísticas. Usos condicionales. No se permitirán usos condicionales. NOTA: TERRENO CON AFECTACIÓN POR RIESGO POTENCIAL DE SOCAVAMIENTO DE RÍO Y CON ANTECEDENTES DE DESLIZAMIENTOS IMPORTANTES (SOLICITAR CRITERIO A LA COMISIÓN NACIONAL DE EMERGENCIAS). LA ZONA NO PERMITE ACTIVIDAD DE CANTERA, SEGÚN EL ARTÍCULO 11.b. DEL REGLAMENTO DEL PLAN REGULADOR VIGENTE DEL CANTÓN DE LA UNIÓN. UN USO DE SUELO NO ES NI OTORGA PERMISO O LICENCIA MUNICIPAL." El referido funcionario al resolver la citada gestión, no deja margen a duda alguna, externando un criterio experto claramente acorde con el contenido de la norma supra citada.

Pese a lo anterior, mediante oficio No. MLU-DJUR-023-2016, fechado 19 de enero de 2016, el Director Jurídico de la Municipalidad de la Unión, Lic. Rommel Calvo Padilla consideró que no resultaba procedente requerir el mismo -entiéndase el Certificado de Uso de Suelo-, debido al carácter vinculante de las recomendaciones emitidas por la CNE, la pirámide Kelseniana -jerarquía normativa-, la "naturaleza reglamentaria de los Planes Reguladores" y una serie de normas hasta del Código Sísmico que utilizó como "fundamento" de su criterio jurídico. (Hecho probado No. 11). Criterio del cual discrepa esta Cámara, pues lo que señaló la CNE fue que debía intervenirse la zona por los riesgos de derrumbes y presamientos en el río, pero nunca que debía otorgarse una concesión de Cantera o bien, que en dicho sector no debía aplicarse el Plan Regulador, por cuanto sencillamente un proceder de tal magnitud sería abiertamente ilegal.

Así entonces, tal y como fue ratificado en Juicio por el Geólogo de la CNE, señor Julio Eduardo Delgado Mora, lo que se estimó como urgente fue la intervención de la zona a efecto de "administrar el riesgo", lo que en modo alguno debe entenderse como un cheque en blanco para obviar el cumplimiento de requisitos esenciales como lo es el Certificado de Uso de Suelo para casos como el que nos ocupa. Dicho de otra forma, la situación descrita por la CNE ciertamente evidenciaba una necesidad de urgente intervención en la zona de comentario, pero ante tal panorama, lo que se requería era precisamente eso, que se interviniera la zona por parte de las autoridades competentes, no que se utilizara tal situación para emitir actos administrativos tendientes a que la empresa codemandada pudiere desarrollar una actividad de Cantera, pese a no encontrase permitida la misma por el Plan Regulador. Es decir, la CNE nunca recomendó -con carácter vinculante- que se otorgara una licencia comercial y una concesión de Cantera, sencillamente por encontrarse legalmente impedida para emitir ese tipo de recomendaciones.

En este sentido cabe recordar, que el Plan Regulador "en razón de su contenido y de su eficacia u obligatoriedad general, debe estimarse que se trata de verdaderas normas jurídicas o leyes en sentido material, toda vez que reconoce derechos y establece obligaciones para los titulares y poseedores de los inmuebles ubicados en la circunscripción territorial del respectivo cantón" (Sala Constitucional 2006-13330 del 06 de setiembre de 2006) y en razón de ello, es que si bien es posible su inaplicación por razones de emergencia, tal circunstancia debe encontrarse amparada a la existencia formal de un Decreto de Emergencia. Acto este último, que por disponerlo así la Ley Nacional de Emergencias y Prevención del Riesgo, tiene la potencia jurídica de desplazar -temporalmente- el Principio de Legalidad y sustituirlo por el de Necesidad. De ahí que se utilice como clásico ejemplo de un acto con valor o fuerza de ley. En esta línea, la citada Ley señala de forma expresa en su artículo 4, lo siguiente:

"Estado de emergencia: Declaración del Poder Ejecutivo, vía decreto ejecutivo, con fundamento en un estado de necesidad y urgencia, ocasionado por circunstancias de guerra, conmoción interna y calamidad pública. Esta declaratoria permite gestionar, por la vía de excepción, las acciones y la asignación de los recursos necesarios para atender la emergencia, de conformidad con el artículo 180 de la Constitución Política." Tan relevante es una declaratoria de emergencia, que el citado cuerpo legal establece ordinal 36- entre otras medidas excepcionales que:

"Los predios de propiedad privada, ubicados en las áreas geográficas determinadas en la declaración de emergencia, deberán soportar todas las servidumbres necesarias para realizar las acciones, los procesos y las obras que deban realizar las entidades públicas bajo la coordinación de la Comisión. Esta disposición deberá incluirse expresamente en el decreto de emergencia. Asimismo, los propietarios estarán obligados a permitir la ocupación temporal de sus predios, cuando sea absolutamente indispensable para atender oportunamente la emergencia. La ocupación temporal deberá limitarse al espacio y tiempo estrictamente necesarios, que debe corresponder a la fase contemplada en el inciso a) del artículo 30 de esta Ley. Deberá procurarse causar el menor daño posible; sin embargo, los daños ocasionados durante esta ocupación podrán indemnizarse a solicitud de parte, siempre que medie avalúo pericial judicial.

Por resolución motivada de acatamiento obligatorio, la Comisión podrá ordenar demoler toda edificación, pública o privada, ubicada en las áreas geográficas incluidas en la declaración de emergencia cuando, por su estado de ruina o deterioro, o bien, por hallarse en un área de inminente peligro, arriesgue la seguridad o salubridad de los habitantes o de otras personas, todo de acuerdo con los estudios técnicos que lo recomienden. Esta resolución no dará lugar a indemnización alguna y contra ella únicamente cabrá recurso de reposición." La situación descrita por las referidas normas, evidencia la excepcionalidad con ocasión de la cual se produce esa especie de desplazamiento del Principio de Legalidad por el de Necesidad, requiriéndose para ello la existencia de una conducta formal -acto con valor de Ley- que no es otra cosa más, que el Decreto mediante el cual se declara el Estado de Emergencia, lo que claramente no ocurrió en el caso que se analiza.

Dicho de otra forma, esa suspensión temporal de los procedimientos ordinarios o si se quiere del Principio de Legalidad, sólo es jurídicamente posible cuando existe tal declaratoria, y un dictamen, recomendación o informe de la CNE por más vinculante que sea -numeral 14.c de la referida Ley-, no tiene jamás, tal potencia jurídica. Ergo, al amparo de tales recomendaciones, informes y/o dictámenes, no es jurídicamente viable desaplicar para un caso concreto el Plan Regulador. Igualmente resulta de relevancia aclarar, que si bien la Municipalidad accionada hace expresa mención a un estudio de suelo aprobado por el INTA -Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria- no realiza a nivel argumentativo un desarrollo de las razones por las cuales considera que a través de un estudio avalado o aprobado por dicho órgano desconcentrado en grado máximo con personalidad jurídica instrumental y adscrito al Ministerio de Agricultura y Ganadería, puede "actualizarse" el uso de suelo previsto en el Plan Regulador, desatendiendo lo que al efecto establece la Ley de Planificación Urbana.

Comprende esta Cámara que hay situaciones en las que el seguir un determinado cauce procedimental no es necesariamente lo más célere. No obstante, el legislador previó no solo tales cauces, sino también las excepciones en su aplicación, sin que en la especie puede afirmarse que nos encontremos ante ella -Declaratoria de Estado de Emergencia-. Así entonces, de existir la necesidad de "actualizar" un Plan Regulador, tal tarea no puede llevarse a cabo a través de un estudio realizado, aprobado, avalado o validado por el INTA, sino mediante el mecanismo previsto en la Ley de Planificación Urbana. Luego, como se ha dicho, la Municipalidad no argumentó absolutamente nada respecto a este tema, como para ahondar en el mismo, pues ni explicó por qué a su juicio es viable esta "vía indirecta de actualización" que utilizó en el caso bajo estudio. Lo que a no dudarlo resultaba de suma trascendencia, si se toma en consideración que el INTA, conforme al ordinal 2 de su Ley de creación, fue ideado con el objetivo de "contribuir al mejoramiento y la sostenibilidad del sector agropecuario, por medio de la generación, innovación, validación, investigación y difusión de tecnología, en beneficio de la sociedad costarricense." Autorizándosele a "vender servicios de investigación agropecuaria siempre y cuando no menoscabe la atención de las demandas de investigaciones de interés social." Y obligándosele a promover y desarrollar "investigaciones relacionadas con la producción agropecuaria orgánica..." facilitando "la transferencia de tecnología entre las personas productoras." Dicho de otra forma, no explica el ente municipal accionado, cómo -entiéndase al amparo de cuáles normas- un Instituto creado para el Sector Agropecuario, a través de un estudio realizado o aprobado por el mismo, puede sustituir, reemplazar, reformar o "actualizar" el uso suelo previsto en un Plan Regulador, sin acudir el Procedimiento contemplado en la citada Ley de Planificación Urbana.

Siempre sobre el actuar municipal, resulta absolutamente desajustado a la realidad, afirmar como lo hizo el Director Jurídico Municipal, Licenciado Rommel Calvo Padilla en su oficio MLU-DJUR-480-2017 del 5 de junio de 2017 (hecho probado No. 14), que la Sección Tercera de este Tribunal al rechazar por extemporáneo el recurso de apelación interpuesto contra la resolución MLU-DAM-DJUR-292-2016 de las 9:00 horas del 26 de mayo de 2016 emitida por la Alcaldía Municipal, -lo que significa que NO se ingresó a valorar el fondo del asunto-, haya ratificado lo actuado por esa entidad municipal; o bien, que con ocasión de lo dicho por ese órgano de control de legalidad -que no realiza función jurisdiccional, sino administrativa, como jerarca impropio bifásico que es- deba o pueda entenderse, que la actuación municipal se encuentra a derecho. Manifestarse en sentido contrario, pese a la claridad en cuanto a que el rechazo del referido recurso lo fue por extemporáneo, resulta a todas luces carente de sustento y análisis técnico-jurídico.

En términos sencillos, si un recurso -como el de comentario- se inadmite o "se rechaza" por extemporáneo, obviamente no se ingresa a valorar la procedencia del mismo por el fondo, precisamente por haberse interpuesto fuera del plazo legal previsto -razón de rechazo, que aclaramos, no está valorando esta Cámara en cuanto a su conformidad o no con el ordenamiento jurídico-. Sea, la inadmisibilidad o "rechazo" de un recurso por extemporáneo, implica que no se hizo análisis de legalidad de la conducta atacada. Llegado a este punto, cabe concluir, que lo actuado por el ente municipal accionado sobre la base de que lo hacía por la existencia de dictámenes, informes o recomendaciones vinculantes emitidos por la CNE, es absolutamente nulo por quebranto evidente y manifiesto del Principio de Inderogabilidad Singular de las Normas, no sólo respecto del ordinal 11.b) del Plan Regulador, sino además los ordinales 28 que prohíbe "aprovechar o dedicar terrenos, edificios, estructuras, a cualquier uso que sea incompatible con la zonificación implantada"- y 29 -en cuanto establece que "sin el certificado de uso correspondiente, no se concederán patentes para establecimiento comerciales o industriales"; ambos de la Ley de Planificación Urbana.

En razón de ello, deben declararse absolutamente nulos la Resolución Administrativa No. MLU-PAT-0127-2016 del 26 de enero de 2016, emitida por la Dirección de Administración Tributaria y la Coordinación del Departamento de Patentes de la Administración Municipal accionada, mediante la cual se dispuso otorgar a la empresa Hacienda San Rafael HRS S.A. la Licencia Municipal No. 04-0717 para la actividad de "TAJOS" y todos los demás actos conexos con la misma -entiéndase anteriores o posteriores, de trámite o de trámite con efecto propio-. En este sentido, para mayor claridad, ha de indicarse que la nulidad aquí decretada de la referida Licencia Comercial, se extiende a los oficios de la Dirección Jurídica MLU-DJUR-023-2016, fechado 19 de enero de 2016 y MLU-DJUR-480-2017 del 5 de junio de 2017, ambos suscritos por el Licenciado Rommel Calvo Padilla, así como la Resolución MLU-DAM-DJUR-292-2016 de las 9:00 horas del 26 de mayo de 2016 emitida por la Alcaldía Municipal, respecto de la cual, la Sección Tercera de este Tribunal rechazó el Recurso de Apelación por considerarlo interpuesto extemporáneamente.

Además, cualquier decisión adoptada por el ente municipal o cualquier otra Administración Pública al amparo de lo indicado por el referido profesional en Derecho en los referidos oficios, resulta de igual forma absolutamente nula. El motivo de nulidad acogido -por su trascendencia-, torna en innecesario el realizar pronunciamiento sobre los demás extremos que fueron esgrimidos por la parte actora. No obstante lo anterior, estima conveniente este Tribunal, advertir a la entidad municipal, que de existir obras realizadas sin permiso constructivo expedido por ese Gobierno Local, su ineludible deber, es proceder en los términos previstos en la Ley de Construcciones -artículos 93 y siguientes-. En lo que atañe a la Viabilidad Ambiental y a la Concesión otorgada a la sociedad accionada -motivos del vi al xii-. En su numeral 6 párrafo primero, el Código de Minería establece que se "declara de utilidad pública toda la actividad minera, tanto en los trabajos de exploración, como en los de explotación.

Tendrán el mismo carácter la concentración, beneficio, transformación, transporte de sustancias minerales y los terrenos de propiedad particular o estatal necesarios para estos fines." Lo así transcrito evidencia a juicio de esta Cámara, que es por ley que se considera de utilidad pública tanto la extracción de materiales como su transporte, incluso por terrenos de propiedad privada. Y siendo ello así, sea, existiendo una norma de rango legal que declara de manera expresa esa utilidad pública, coincide este Órgano Colegiado con la postura de la Representación Estatal, en cuanto a que el Poder Ejecutivo no necesitaba justificar el interés público inherente en la concesión otorgada a la empresa codemandada a través de la resolución No. R-083-2015-MINAE. En este sentido, revisados los expedientes administrativos no observa este Tribunal que tanto la Nombre3456 como la Dirección de Geología y Minas, hayan sustentado sus actuaciones en alguna emergencia o riesgo inminente, sino que, como de manera acertada lo aduce el Órgano Procurador, concibieron desde un inicio del procedimiento que la solicitud de la empresa codemandada, tenía un fin evidentemente comercial de explotar la Cantera.

Circunstancia, que explica el plazo y el área otorgada en concesión a tono con lo dispuesto en el Código de Minería, pues no estaba ni está pensado en atender el tema del riesgo de derrumbes en la zona, sino, en procurar que el proyecto concesionado sea factible. De ahí que no se evidencie siquiera tangencialmente, quebranto a los Principios de Proporcionalidad y Razonabilidad en razón del plazo y el área que abarca la Concesión de comentario. Luego, el impacto positivo en la disminución del riesgo de deslizamientos que los testigos expertos Julio Eduardo Delgado Mora -Geólogo de la CNE- y Etelberto Chavarría Camacho -funcionario de la Dirección de Geología y Minas- reconocieron en Juicio ha tenido la referida Concesión, no tiene absolutamente nada que ver con el "motivo" con ocasión del cual, fue concedida la misma. Ahora bien, desde la perspectiva estrictamente ambiental y de participación ciudadana, no se aprecian tampoco las falencias que se aducen, pues incluso del Estudio de Impacto Ambiental elaborado por la empresa codemandada se desprende el proceso de consulta a la comunidad con participación del Concejo Municipal de La Unión y consta en el expediente administrativo la publicación en un diario de circulación nacional avisando de la presentación de dicho estudio, con una descripción del proyecto de concesión en cuestión, sin que conste que la actora o cualquier otro interesado dentro del plazo de 10 días hábiles conferido, haya manifestado su oposición.

Siempre sobre este mismo tema de publicidad y transparencia, durante el trámite seguido para el otorgamiento de la Concesión Minera, consta en el expediente identificado con el No. 2754, la publicación del correspondiente edicto los días 6 y 10 de junio del 2014 en La Gaceta dando aviso del proyecto de concesión para extracción de materiales solicitado por la empresa codemandada, sin que dentro de los quince días hábiles siguientes a la última publicación se haya presentado objeción alguna por parte de la Asociación actora o de cualquier otro interesado. Por último, sobra decir, que el tema vinculado al Certificado del Uso de Suelo -que en este caso el Gobierno Local ilegalmente decidió no exigir-, es competencia exclusiva y excluyente de la Municipalidad de La Unión. Es decir, para efectos de la Viabilidad Ambiental y la Concesión de comentario, Nombre3456 y la Dirección General de Geología y Minas, no se encontraban legalmente obligadas a exigir el Certificado de Uso de Suelo expedido por la Municipalidad accionada, pues ese y otros requisitos -como el Permiso Sanitario de Funcionamiento-, son necesarios para otro tipo de trámites como licencias comerciales, por ejemplo, no para la tramitación de la Viabilidad Ambiental y la Concesión.

Lo antes señalado evidencia entre otras cosas, el carácter instrumental de la Viabilidad (Licencia) Ambiental otorgada mediante la citada resolución 2191-2013-SETENA, pues dicho acto no exime a su destinatario, de cumplir con el resto de permisos de las autoridades competentes que son exigidos por el Ordenamiento Jurídico para poder desarrollar la actividad de explotación de Cantera, en este caso. (Sobre esa instrumentalidad de la Licencia Ambiental, puede consultarse por su claridad, la Sentencia No. 35-2009 de las quince horas nueve minutos del catorce de enero de dos mil nueve, emitida por la Sección Sexta de este Tribunal). De igual forma, en lo atinente a la Concesión otorgada mediante la resolución No. R-083-2015-MINAE, el ordinal 12 del Código de Minería establece el alcance limitado de dicho título habilitante, debiendo cumplir el concesionario con el resto de requisitos previstos en el Ordenamiento Jurídico para poder dar inicio a las labores de extracción.

Esto último -alcance de la Concesión y la necesidad de contar con demás permisos, licencias y autorizaciones de otras Administraciones Públicas- se evidencia además de la contestación a las dudas que fueron planteadas ante el Registro Nacional Minero tanto por la Auditora Municipal como por la empresa accionada. (Hechos probados Nos. 8, 9 y 13). En consecuencia, durante la tramitación de la Viabilidad Ambiental y de la Concesión, no aprecia esta Cámara que se haya incurrido en acciones u omisiones capaces de invalidar lo actuado por la Nombre3456 y la Dirección de Geología y Minas. Siempre sobre el tema bajo análisis, coincide este Tribunal con el Órgano Procurador respecto a que si bien la parte actora cuestiona aspectos estrictamente técnicos relacionados con la intervención en la margen derecha del Río Chiquito y las medidas de mitigación aprobadas en la Viabilidad (Licencia) Ambiental, lo hace a partir de argumentaciones y criterios suyos sin referencia a fundamento técnico alguno que evidencie lo que aduce.

Contrario a ello, del elenco de hecho probados contenidos en el presente Fallo, así como de la declaración en Juicio de los supra citados funcionarios, se aprecia que tanto la SETENA, como la Dirección de Geología y Minas, al momento de analizar la gestión de la empresa codemandada, tomaron en cuenta la alta inestabilidad de la zona del proyecto y la situación de vulnerabilidad existente, con fundamento en las conclusiones arrojadas por el informe No. DPM-INF-0852-2011 de la CNE. Así fue como desde una perspectiva técnico-científica, tal y como lo afirma el Órgano Procurador, ambas Administraciones determinaron que la explotación de la Cantera, al tiempo que cumplía con los fines propios de este tipo de actividades, podía servir como una medida para mitigar el riesgo de represamiento del río Chiquito y contribuir a la estabilización del macizo de tierra. Por lo que, esta Cámara no observa que haya contradicción entre lo dispuesto en ese primer informe de la CNE y la emisión de los actos impugnados.

En cuanto al tema del monitoreo, siendo que los testigos-peritos de la CNE, reconocieron la existencia de un sistema de monitoreo que si bien es distinto al pretendido por quien acciona, ha dado resultados adecuados, no encuentra esta Cámara motivo técnico-científico para disponer su cambio u ordenar alguna otra medida adicional sobre tal tema. En lo atinente a la limpieza del cauce del río, ciertamente es una labor que deberá seguir realizando el ente municipal demandado en coordinación con la CNE, siendo que lo relativo a los "análisis más detallados" que indica la actora no es dable atenderlo en tanto no explica ni detalla a qué se refiere con ello y en todo caso, los funcionarios citados, tanto de la CNE como de la Dirección General de Geología y Minas, manifestaron en Juicio que existe un seguimiento técnico-científico relacionado con la vulnerabilidad de la zona -derrumbes y represamiento del río-.

Conforme a lo hasta aquí señalado, respecto a lo actuado por Nombre3456 y la Dirección General de Geología y Minas, la demanda debe ser declarada sin lugar como en efecto se dispone. Ahora bien, por considerar esta Cámara que la nulidad aquí declarada es evidente y manifiesta -entiéndase grosera-, se ordena comunicar la presente Sentencia tanto a la Contraloría General de la República como a la Fiscalía Adjunta de Probidad, Transparencia y Anticorrupción, quedando tanto el expediente judicial como los administrativos, a disposición de dichas autoridades, para que dentro del ámbito de sus competencias, valoren la apertura de las investigaciones que estimaren pertinentes, sin que sea necesario que comuniquen a esta Cámara lo que finalmente llegaren a decidir.

VI. DE LA EXCEPCIONES OPUESTAS

Tal y como fue indicado en el Resultando II de esta Sentencia, las representaciones de los accionados opusieron las siguientes excepciones:

  • 1)Hacienda San Rafael HSR S.A.: Falta de Agotamiento de la Vía Administrativa, Indebida Acumulación de Pretensiones, Litispendencia, Falta de Legitimación tanto Activa como Pasiva y Falta de Derecho. (Imágenes 264 a 292).
  • 2)Municipalidad de la Unión: Falta de Agotamiento de la Vía Administrativa y en Juicio durante su Alegato de Apertura adujo la Falta de Interés Actual. (Imágenes 353 a 372, 412 y 416 a 444 del expediente judicial. Respaldo electrónico de la Audiencia de Juicio Oral y Público).
  • 3)Estado: Falta de Derecho. (Imágenes 376 a 407 del expediente judicial). Las defensas previas de Falta de Agotamiento de la Vía Administrativa, Litispendencia e Indebida Acumulación de Pretensiones, fueron rechazadas por el Juzgador de Trámite en la Audiencia Preliminar mediante resolución No. 1925-2018 de las de las catorce horas treinta y cinco minutos del veintinueve de noviembre de dos mil dieciocho. En cuanto a la Falta de Legitimación opuesta en su doble vertiente por la empresa codemandada, baste decir que la misma debe rechazarse en tanto claramente de figurar como parte demandada por quien acciona, debido a que deriva derechos e intereses legítimos de las conductas cuestionadas. (Artículo 12.3 CPCA). En lo que atañe a la Falta de Interés Actual opuesta por la Representación Municipal, se impone su rechazo, toda vez que a la fecha en que se emite la presente Sentencia, no se aprecia que las pretensiones de la accionante hayan sido satisfechas en sede administrativa o que pese al acogimiento de alguna de ellas en este Proceso, no vaya a tener impacto en el ámbito jurídico. Dicho de otra forma, fallar por el fondo el presente asunto sigue siendo útil y en ese tanto actual, en tanto la Sentencia impactará la esfera jurídica de quienes se encuentran vinculados en esta relación jurídico-procesal. Por último, respecto de la excepción de Falta de Derecho opuesta por el Órgano Procurador, en tanto el ordenamiento jurídico no ampara lo argumentado y pedido contra el mismo, lo procedente es acoger la misma, como en efecto se dispone.

VII. SOBRE LAS COSTAS

El artículo 193 del CPCA establece que las costas procesales y personales son impuestas al vencido por el solo hecho de serlo, pronunciamiento que debe hacerse incluso de oficio, al tenor de lo dispuesto en esa misma norma, en concordancia con el numeral 119.2 ibídem. La dispensa de esta condena solo es viable: a) cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar; b) cuando la sentencia se dicte en virtud de pruebas que desconociera la parte contraria; o bien, c) cuando se incurra en plus petitio, esto es, cuando la diferencia entre lo reclamado y lo obtenido en definitiva sea de un quince por ciento (15%) o más, a no ser que las bases de la demanda sean expresamente consideradas provisionales o su determinación dependa del arbitrio judicial o dictamen de peritos (ordinal 194 ibídem). En la especie, estima esta Cámara que en cuanto la demanda fue dirigida con éxito contra la Municipalidad de La Unión, quien a Juicio de este Tribunal incurrió en ilegalidades evidentes y manifiestas es dicha entidad quien debe correr con las costas procesales y personales- a favor de la parte actora.

En lo que atañe a la sociedad demandada, la misma fue llamada al Proceso en tanto derivaba derechos e intereses de las conductas impugnadas y en ese tanto se vio obligada a litigar, sin que se aprecie que tal litigio haya sido de mala fe, pues de los autos no se desprenden conductas procesales temerarias o una postura absurda en defensa de su esfera jurídica. Y en ese tanto, respecto de la misma, el presente asunto se falla sin especial condenatoria en costas. En cuanto al Estado, el mismo fue traído al Proceso por cuanto dos de sus dependencias fueron autoras algunas de las conductas impugnadas y la demanda en su contra ha sido declarada sin lugar, razón por la cual, lo procedente respecto del mismo, es resolver sin especial condenatoria en costas. Ahora bien, a pesar del sin lugar antes dicho, estima este Órgano Colegiado que la Asociación actora no debe correr con las costas a favor del Estado, pues claramente la misma tuvo motivo suficiente para litigar, en tanto no sólo la situación planteada involucra aspectos técnicos de otra ciencia distinta al Derecho -como la Geología-, sino que además, la propia perspectiva jurídica en este asunto resulta de alto grado de complejidad y ello, aunado a la maraña jurídica que creó la Municipalidad accionada para intentar "justificar" su ilegal accionar, razonablemente permitía proyectar a la Asociación actora, que todo podría estar viciado de nulidad, incluido obviamente lo relativo a la Viabilidad Ambiental y la Concesión.

Así las cosas, se reitera que en criterio de esta Cámara, la Asociación actora tenía motivo suficiente para accionar contra el Estado y en razón de ello, pese al rechazo de su demanda contra dicho Ente Mayor, se estima que no ha lugar a la condenatoria en costas pedida por la Representación Estatal.

POR TANTO

Se admite la prueba para mejor resolver aportada por el Estado y la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias -CNE-. Se rechazan las excepciones de Falta de Legitimación tanto Activa como Pasiva, así como de Falta de Interés Actual. Se declara parcialmente con lugar la demanda incoada por la Asociación de Vecinos de la Urbanización Sierras de La Unión contra la Municipalidad de la Unión y la Hacienda San Rafael HSR S.A., entendiéndose denegada en lo no expresamente concedida: i) Se anula la Resolución Administrativa No. MLU-PAT-0127-2016 del 26 de enero de 2016, emitida por la Dirección de Administración Tributaria y la Coordinación del Departamento de Patentes de la Administración Municipal accionada, mediante la cual se dispuso otorgar a la empresa Hacienda San Rafael HRS S.A. la Licencia Municipal No. 04-0717 para la actividad de "TAJOS" y todos los demás actos conexos con la misma -entiéndase anteriores o posteriores, de trámite o de trámite con efecto propio-.

En este sentido, para mayor claridad, ha de indicarse que la nulidad aquí decretada de la referida Licencia Comercial, se extiende a los oficios de la Dirección Jurídica MLU-DJUR-023-2016, fechado 19 de enero de 2016 y MLU-DJUR-480-2017 del 5 de junio de 2017, ambos suscritos por el Licenciado Rommel Calvo Padilla, así como la Resolución MLU-DAM-DJUR-292-2016 de las 9:00 horas del 26 de mayo de 2016 emitida por la Alcaldía Municipal, respecto de la cual, la Sección Tercera de este Tribunal rechazó el Recurso de Apelación por considerarlo interpuesto extemporáneamente. Además, cualquier decisión adoptada por el ente municipal u otra Administración Pública, al amparo de lo indicado por el mencionado profesional en Derecho en los referidos oficios, resulta de igual forma absolutamente nula. ii) Tome nota la entidad municipal de lo indicado en este Fallo respecto de cómo debe procederse en caso de que existan obras construidas sin permiso municipal. iii) Las costas procesales y personales correrán por cuenta de la Municipalidad de la Unión, quedando la determinación de su quantum para la Etapa de Ejecución de Sentencia a instancia de la Asociación vencedora.

Pues respecto de la codemandada Hacienda San Rafael H.R.S. S.A., se falla sin especial condenatorio en costas. iv) Por considerar esta Cámara que la nulidad aquí declarada es evidente y manifiesta -entiéndase grosera-, se ordena comunicar la presente Sentencia tanto a la Contraloría General de la República como a la Fiscalía Adjunta de Probidad, Transparencia y Anticorrupción, quedando tanto el expediente judicial como los administrativos a disposición de dichas autoridades, para que dentro del ámbito de sus competencias, valoren la apertura de las investigaciones que estimaren pertinentes, sin que sea necesario que comuniquen a esta Cámara lo que finalmente llegaren a decidir. En lo que la demanda se dirigió contra el Estado, se acoge la excepción de Falta de Derecho y en consecuencia, la misma se declara sin lugar en todos sus extremos, siendo que por las razones dadas en cuanto a ello, se resuelve sin especial condenatoria en costas. NOTIFÍQUESE.- Elías Baltodano Gómez, Juez Ponente, Nombre71914 Reyes Castillo, Jueza e Iván Salas Leitón, Juez.-
