Rolando Alberto Segura Ramírez, married once, resident of Vásquez de Coronado, holder of identity card number 1-0625-0122; and Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (hereinafter, Senara), represented by its Special Judicial Attorneys-in-Fact, Lic. Enmanuel López Vargas, married, holder of identity card number 7-132-772, and Giovanni López Jiménez, divorced, holder of identity card number 1-701-815. All are adults and attorneys.- BACKGROUND
I.On 07 de febrero de 2018, the company Inversiones Pelyo del Este S.A. brought a proceeding on the merits against the State, Senara, and Municipalidad de Vásquez de Coronado, asserting the following claims for relief (pretensiones): “1. That this action be granted in all respects. 2. Because the requirements for applying the strict liability (responsabilidad objetiva) of the Public Administration have been met, that the co-defendants—namely SENARA, the State, and Municipalidad de Vásquez de Coronado—be held jointly and severally liable for the following amounts, set prudentially—without prejudice to adjustment during the course of the proceedings—until recognized in a final and binding judgment, as follows: A. For pecuniary damage (daño patrimonial), understood as the expenses the plaintiff was required to incur as a direct and causally related result of the defendants’ actions in purchasing the land, and the value of the buildings; namely: ¢ 804.151.715 CRC (EIGHT HUNDRED FOUR MILLION ONE HUNDRED FIFTY-ONE THOUSAND SEVEN HUNDRED FIFTEEN COSTA RICAN COLONES).
B. For consequential losses (perjuicios), understood as the monetary sums not received, equivalent to what would have been earned had the amount actually spent been invested in six-month debt securities issued by Banco Nacional de Costa Rica; namely: ¢ 210.679.142 CRC (TWO HUNDRED TEN MILLION SIX HUNDRED SEVENTY-NINE THOUSAND ONE HUNDRED FORTY-TWO COSTA RICAN COLONES). 3. That the co-defendant Municipality be ordered, under the adjudicators’ standard of reasoned judgment (sana crítica), to compensate the non-pecuniary damage (daño moral) caused to the plaintiff’s commercial reputation and image in its activities in the domestic free market. This is because the Municipality persisted in maintaining the initially adopted suspensive interim measure (medida cautelar suspensiva), despite the existence of technical and legal opinions from the Municipality’s own internal bodies that did not endorse the continued effect of that suspension, and despite the order of the Sala Constitucional, which made such suspension conditional upon requirements that the plaintiff duly satisfied.
Under this heading, an award in the amount of ¢ 5.000.000 CRC (FIVE MILLION COSTA RICAN COLONES) is requested. 4. That the co-defendants be held jointly and severally liable for payment of damages and consequential losses (daños y perjuicios) in the amounts stated above, except for the non-pecuniary damage, which is attributable solely and exclusively to the defendant Municipality, as stated in the preceding claim (number 3). 5. In the event that the judgment imposes an unliquidated award (condena en abstracto) against the co-defendants, whether wholly or partially, the rights of our client shall be asserted during the judgment-enforcement stage (etapa de ejecución de sentencia), notwithstanding the precise identification and quantification stated and duly substantiated herein. 6. That the co-defendants be held jointly and severally liable for payment of statutory interest (intereses legales) until fully paid, without prejudice to any applicable monetary indexation (indexación monetaria). 7.
That the co-defendants be held jointly and severally liable for both categories of costs (ambas costas), without prejudice to the foregoing provisions concerning damages and consequential losses.” (See complaint at images 1 through 37 in the digital case file).-
II.After service of process as prescribed by law (traslado de ley), the defendants opposed the action. Municipalidad de Vásquez de Coronado requested dismissal of the complaint and an order requiring the plaintiff to pay both categories of costs. The State requested dismissal of the complaint, raised the defenses of lack of standing to sue and be sued (falta de legitimación activa y pasiva) and absence of a legal right (falta de derecho), and requested that the plaintiff be ordered to pay costs and interest. Senara likewise requested that the complaint be denied, that costs be awarded, and raised the defenses of lack of standing to be sued and absence of a legal right. III.The preliminary hearing (audiencia preliminar) was held at 13:35 hours on 6 de diciembre de 2018, with representatives of all parties present. (See the preliminary hearing and minutes in the digital judicial case file).-
IV.The oral and public trial (juicio oral y público) was held on 25 de noviembre de 2021, with all parties participating. At that hearing, due to the health conditions then in effect, the Court proceeded directly to receive the expert and testimonial evidence admitted at the preliminary hearing; it ordered reconstruction of the case file submitted by Municipalidad de Vásquez de Coronado, and, once the file had been reconstructed, the parties were heard regarding that evidence and granted a period for submitting closing arguments. V.This judgment is issued within the statutory period, taking into account the holiday of 29 de noviembre de 2021, the court recess of 10 de diciembre de 2021, the collective closure of the Poder Judicial, and the period granted to reconstruct the administrative case file and submit closing arguments. It is issued unanimously, following deliberation by the members of the Court, with no grounds having been identified that could invalidate the proceedings.-

CONSIDERING
At the preliminary hearing held at thirteen thirty-five on the sixth day of December, two thousand eighteen, the Municipality submitted a series of documents concerning which the Presiding Judge (Juez de Trámite) granted the other parties time to respond, with this Trial Court to determine whether to admit or reject them. Likewise, on the day of the oral and public trial, the Municipality offered a memorandum dated 23 de noviembre de 2021 concerning the value declared by the plaintiff company for property number 569222 of the Partido de San José, and the parties were heard regarding that memorandum at that time. With respect to that evidence (probanza), this Chamber determined that it would review it during deliberations and decide whether to admit or reject it. Having reviewed the evidence, the Court concludes that part of it is already contained in the administrative case files admitted into evidence; however, there is an updated land-use certificate (certificado de uso de suelo) for the year 2018. That document and the document submitted on the day of trial are admitted insofar as they provide evidence relevant to resolving this dispute.-
II.PROVEN FACTS.- Of importance to the resolution of this matter, the following is deemed duly established:
Upon review of the documents submitted, said Department states, by official letter S.A.2.3.34-1006-11 of 7 de octubre de 2011, that it is environmentally feasible to approve the construction if the Construction Planning and Control Department approves it. (See pages 259 to 266 of Volume I and pages 354 and 355 of Volume II of the case file submitted by the Municipality of Vásquez de Coronado);

The scope under the regulations is to determine whether the site and soil are suitable for a service station; therefore, Senara evaluates the site and reviews its vulnerability, also using information provided by the project consultant and obtained from the review. The vulnerability was rated as moderate. He states that the developer submits soil studies and investigations of the surrounding water-table (nivel freático) levels and degree of confinement. They review whether the aquifers are unconfined and whether they are susceptible to contamination. He explains the degrees of vulnerability and states that the study found moderate vulnerability, meaning susceptibility to contamination by an atypical activity. This depends on the soil and its susceptibility. When asked whether it is possible to build a service station in an area of moderate vulnerability, he states that it is, and that there would be no problems with construction if the appropriate measures are incorporated into the construction model.
He indicates that Senara does not use plans; it reviews the condition of the soil, while the other institutions address those matters. He states that its review does not grant a building permit or land-use authorization (uso de suelo). Regarding the construction problem, he states that in 2012 a memorandum was received from the Municipalidad de Coronado after a site visit was conducted and water seepage (afloramiento de agua) was detected in the tanks. He mentions that the flow rate (caudal) was 4,2 liters per second, which is enough to supply water to 800 people. He states that the water seepage and its sources were investigated to gain a better understanding. He adds that the seepage occurred in one corner of the fuel-supply pit. He further states that the Sala Constitucional suspended construction in 2013. It was determined that, after the layers were removed, the aquifer was already at risk and that a mitigation process (proceso de mitigación) had to be undertaken to restore the site; Setena also participated in that process.
It consisted of filling and compacting the seepage area and compacting the soil up to the level where it had been cut. He mentions that the ground had been lowered to bare earth and approximately 5.8 meters had been removed. He states that the system was altered but that the impact was mitigated. He adds that the remainder of the property had moderate vulnerability and that it was necessary to inspect it, determine the condition in which the site had been left, evaluate it, and propose another construction system. He states that because the project was not resubmitted to Senara, no other construction solutions were considered. The State asks no questions. In response to questions from the Municipalidad, he states that he participated in the mitigation or remediation process (proceso de remediación) and in restoring the aquifer to its condition before it was affected. Permeability tests were conducted in that area, and the land was left suitable, although another assessment was required.
He adds that on that occasion they did conduct a second and more thorough assessment of the site. The hydrological-impact analysis (análisis del impacto hidrológico) depends on the type of activity. The site was left ready for further assessments. When asked whether Senara recommended a precautionary measure (medida cautelar) to the Municipalidad, he states that it was indicated that the construction stage could not continue unless remediation was performed first. When asked why the aquifer was affected, he mentions that they may have excavated too deeply. In response to questions from the plaintiff, he states that, once the technical closure (cierre técnico) had been completed, an opinion was issued stating that Senara’s and Setena’s mitigation requirements had been satisfied. When asked whether mitigation and remediation mean the same thing, he states that both terms are used in hydrology.
He adds that, although the tanks had not been installed, hydrocarbon analyses were nevertheless performed. He states that he does not remember whether the technical-closure report included recommendations. (Statement in the trial-recording system in the judicial case file); 90) At the oral and public trial, testimony was received from Gilbert Benítez Rodríguez, who stated that he had been a Civil Engineer since 2014. He has worked for the Municipalidad de Vásquez de Coronado since 2000. In response to questions from the Municipalidad, he states that he remembers complaints from residents and water seepage at the site in 2012. When asked about the land’s original topography, he states that it was 1 or 2 meters. The pit initially had no depth; later, during the technical closure, it was said to be between 5 and 5 and a half meters deep. When asked whether a large amount of soil had been removed, he states that approximately two meters were first removed down to street level and then one additional meter.
Regarding the seepage, he states that they reached the aquifer and attempted to pump out the water. He mentions that Senara ordered the closure of the pit where water was seeping. He adds that the study was conducted by his former supervisor. He mentions that the pit was filled with special concrete and that the soil was compacted to the required level. When asked about permitted land uses (usos de terreno), he states that the Regulatory Plan (Plan Regulador) allows other uses. The State asks no questions. Senara asks about the Regulatory Plan, and he states that it was published in La Gaceta 78 of 28 de abril de 1998. The permitted uses are set forth in Article 20 of the Regulatory Plan. The plaintiff asks whether he participated in issuing Pelyo’s permits and land-use authorizations, and he states that he did not. When asked whether he is familiar with Pelyo’s case file, he adds that he is not.
When asked whether he knows if the measures were lifted, he states that he does not. When asked whether he has experience with hydrocarbons, he states that he does not. (Statement in the trial-recording system in the judicial case file); 91) At the oral and public trial, testimony was received from Manuel García Murillo, who stated that he is a political scientist and served as an alternate council member of the Municipalidad de Vásquez de Coronado from 2010 to 2016. In response to questions from the Municipalidad, he states that he was an assistant to the Mayor from 2006 to 2007 and currently holds that position. Regarding the 2012 service station, he states that the matter came before the Concejo Municipal following a series of submissions by neighborhood and environmental groups concerned about the urban-planning regulation applicable to the project and about the permits. There was public participation on the matter, and a report was requested from the Municipalidad.
He adds that people requested a hearing because of a nearby kindergarten. Someone also questioned whether the Regulatory Plan authorized that type of project. He likewise states that inquiries were received from a newspaper in the canton. He adds that when the water seepage occurred, the objections intensified and the ICAA wells were affected. He indicates that the community demanded action from the Municipalidad, and all of this culminated in the harmfulness proceeding (proceso de lesividad). He adds that an amparo proceeding (recurso de amparo) had previously been filed. When asked whether he is familiar with the Regulatory Plan, he states that he is and that, unlike in other zones, the Plan did not expressly state that this activity could be carried out in that zone. The Concejo stated that the Plan was not to be interpreted but applied. When asked whether the service station conformed to the Regulatory Plan, he states that it did not.
When asked about conforming uses (usos conformes), he states that this is not his area of expertise and that other commercial activities may be conducted there. When asked whether he knows if the Sociedad was denied authorization for other uses, he states that he does not remember. The State asks him to clarify the harmfulness proceeding. Senara asks whether he knows which documents were annulled. He mentions the land-use authorization and the building permit. The plaintiff asks whether the submissions filed by the individuals are in the Municipalidad’s case file, and he states that he does not know. He is asked to clarify the Regulatory Plan and its application, and he states that the issue arose because there had been an interpretation concerning land use in that zone, and it was said that the use had to be expressly identified for the zone. When asked whether the party had a right, he responds that this was why a harmfulness proceeding was brought against it.
When asked why the harmfulness proceeding was requested, he mentions that it was due to citizens’ complaints, which they redirected through the appropriate channels, as well as the amparo proceedings. When asked about the other service stations in Coronado, he states that there are technical and legal problems. When asked whether there were problems involving Pelyo, he states that the Concejo does not review those permits and that he does not know. It is relevant to note that the parties did not establish the following material facts: 1) The cost of the materials, consulting services, and labor relating to the progress of the construction carried out on property number 569222 of the Partido de San José. 2) That, as a result of the nullity of the land-use certificate (certificado de uso de suelo), property number 569222 of the Partido de San José was withdrawn from commerce and rendered entirely valueless. 3) That the plaintiff company was authorized to sell hydrocarbons. 4) That property number 569222 of the Partido de San José was acquired by the plaintiff solely for the purpose of establishing a service station thereon. 5) The non-pecuniary damages (daño moral) claimed by the plaintiff company. (the case record).-
In its complaint, the plaintiff company asserts, insofar as relevant, that: “(...) LAW I.- REGARDING THE LIABILITY OF THE STATE AND ACTIVE PUBLIC ADMINISTRATIONS. European courts have long insisted that the clear and unequivocal acknowledgment by the Public Administration, as regards the certainty of the harm caused, in turn entails an implicit admission of the cause giving rise to the injury sustained, since whether financial liability may be imposed is established by a series of mandatory rules that are binding upon it by virtue of, with due regard for, and in compliance with the strict scope of the principle of legality (principio de legalidad). This issue, as will be seen, is particularly important to the present case by virtue of the express acknowledgment made by one of the defendants when it instituted proceedings for a declaration of harmfulness (proceso de lesividad) under court case number 15-10009-1027-CA, which is awaiting a judgment on the merits from the Tribunal Contencioso Administrativo.
Thus, we must begin by bearing in mind that the provisions governing the liability of the active Administration refer solely and exclusively to the alleged damages and losses (daños y perjuicios) caused to the plaintiff’s private property as a consequence of the normal or abnormal, lawful or unlawful operation of the active Administration. Indeed, the strict liability (responsabilidad objetiva) imposed upon the active Administration by Articles 190 et seq. and related provisions of the Ley General de la Administración Pública (LGAP) provides that the respective Public Administration shall be liable for all harm suffered by private parties to their property and rights as a result of its lawful or unlawful, normal or abnormal operation, except in cases of force majeure (fuerza mayor), fault of the victim (culpa de la víctima), or an act of a third party (hecho de un tercero). The causal relationship (relación causal) arising from the normal or abnormal operation of the active Administration also applies to municipalities as decentralized entities based on cantonal territory.
Consequently, pursuant to the definition in Article 1 thereof, the active Administration is responsible for compensating private parties for damages and losses caused to their property, provided that such damages and losses are certain (not hypothetical), causally related to administrative conduct (conductas administrativas), economically quantifiable, and capable of being individualized in their material effects. Thus, the LGAP embraces the principle governing the scope of State liability, as may be confirmed by simply reading its Article 190, which provides that the Administration shall be liable for all harm caused by its lawful or unlawful, legitimate or illegitimate, normal or abnormal operation. Nevertheless, the transition from the application of the Código Civil—see Article 1045—to the LGAP entailed years of adaptation, so much so that, as late as 1991, it was still common to find claims for payment framed from a strictly civil-law perspective.
In this regard, the SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA has stated: “Therefore, the system has evolved from one in which the victim was required to prove the agent’s negligence or intent in order to hold the State liable, to one in which it is no longer necessary to identify the agent who caused the harm; rather, what must be demonstrated is that the harm resulted from administrative illegitimacy, unlawfulness, or abnormality, or from legitimate, lawful, and normal actions. In the latter circumstances, however, it must also be shown that the injury is exceptional, either because of the small proportion of persons affected or because of its severity, in which cases compensation is limited to actual damages and does not include consequential losses.” (In this regard, see: SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA, No. 45, at 14:45 hours on April 25, 1995.) To the foregoing, we must add that, where the elements of strict liability identified above are present, compensation for the harm must be full—that is, it must encompass both pecuniary and non-pecuniary harm (daño patrimonial y moral), as well as the corresponding losses.
In this regard, the SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA has stated: “(...) compensation for the harm must be full, in integrum,” and in no way merely symbolic, and it must include non-pecuniary harm... Finally, Article 191 thereof requires the Administration to remedy all harm caused to the subjective rights (derechos subjetivos) of others by the failings of its public servants, thereby reinforcing the position that non-pecuniary harm must be compensated, because ‘all harm’ is a broad concept encompassing both material and non-pecuniary harm.” (In this regard, see: SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA, No. 118, at 14:40 hours on November 6, 1996.) In any event, it has been through the development of the case law of the SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA that concepts of particular importance, such as abnormality (anormalidad), have been clarified and defined. In this regard, it has been stated: “(...) it concerns administrative conduct that, in and of itself, departs from good administration (in accordance with the concept used by the Ley General itself in Article 102(d), which includes, among other things, effectiveness and efficiency), or from organizational standards, technical rules, expertise, or prudent practice in the performance of its activities, thereby causing harm to the person.
This makes it possible to state that abnormality may manifest itself through malfunctioning, delayed operation, or a complete failure to operate. Abnormality and unlawfulness must therefore not be treated as equivalent concepts, not even in the circumstance where an operation that is required or consistent with the aforementioned rules produces a harmful result (referred to by some scholars as ‘abnormal operation by result’), because in such a case liability arises from normal operation having a harmful effect or result, which is compensable, of course, provided that the requirements expressly predetermined by the legal system itself are satisfied (see Article 194 of the Ley General de la Administración Pública).” It should now be noted that the concept of abnormality encompasses situations involving the Administration’s inactivity or omission; in other words, situations in which, despite the existence of a functional duty to act or a need for functional diligence, no action whatsoever is taken, thereby causing harm with an adverse financial effect.
Consequently, when Article 190 of the Ley General de la Administración Pública provides that the Administration is liable for normal and abnormal operation, this includes strict liability for administrative inactivity (inactividad administrativa), provided that there is a functional duty to act or to perform required conduct, as occurs in the case sub examine. In this regard, we must note that considerable attention has been given to the distinction between formal omission (omisión formal) and material omission (omisión material), the former occurring within the framework of administrative proceedings (procedimiento administrativo) when an administrative act (acto administrativo) that should be issued is not issued. This is precisely the situation applicable to the present case, given the refusal to lift the precautionary measure (medida cautelar), despite compliance with all the conditions established by the SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA and the competent authorities.
Moreover, material omission occurs when a previously established obligation to undertake a material or technical action is disregarded. The introduction of omission as a form of abnormality is of utmost importance in the case law because, regrettably, it is a typical and expedient feature of Costa Rican institutional practice. Thus, omission as a form of abnormality in administrative operation constitutes a basis for attribution of liability (fuente de imputación) insofar as it is the cause giving rise to an injury, thereby imposing a duty to compensate. Regarding the matter before us, the SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA has stated as follows: “(...) Accordingly, it must be emphatically affirmed...that the Public Administration is also liable for the damages and losses caused by its inactivity. For purposes of non-contractual financial liability (responsabilidad patrimonial extracontractual), such passivity in fulfilling preexisting obligations constitutes abnormal operation of the Administration, insofar as it relates to a required material activity and to unlawful conduct—which, in this case, may be concurrent—inasmuch as the failure to perform what is required not only violates the rules of good administration but also infringes the legal order, since it constitutes a failure to exercise the functional administrative powers deriving from the Legal System itself.
This is all the more pronounced where public services are concerned, because failure to perform a publicly owned activity or work, most often one that is also in the public interest, increases the level of risk inherent in the service and exacerbates its impact on the community, potentially causing direct injury to the particular subjective legal positions of private parties. In this area of public liability for inaction, the injury may arise directly and exclusively from administrative indolence, insofar as that indolence is sufficient in itself to produce an adverse effect on the preexisting or potential legal position of the holder of a full subjective interest (interés subjetivo pleno). But it also frequently occurs—and with increasing frequency—that the injury is caused by two forms of conduct: one consisting of action by a public or private agent that causes impairment within the vital legal sphere of the injured party or parties; and another, concurrent with the former, consisting of the inaction of the public authority that fails to perform, as required, the conduct necessary to prevent the harm.” Among all the foregoing, an issue of particular importance to the present case stands out, relating to the degree of participation of the various actors involved in certain forms of active joint participation, as well as the possible connection between each form of conduct and the injury attributed to it.
In this regard, it is imperative to examine the so-called adequate cause (causa adecuada). That is, it must be determined which of all the omissions caused the greatest harm in terms of severity or whether, conversely, the harm resulted from the combined effect of several omissions. As stated, in the case sub examine the causal harm is the result of actions and omissions (administrative conduct) that make it possible to establish this causal relationship on a joint-participation basis, given the degree of shared responsibility for the adverse impact on our client’s material and non-pecuniary interests. Indeed, in similar cases our judicial authorities have applied Articles 9 and 10 of the LGAP and Article 1046 of the Código Civil. Regarding this issue, the SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA stated: “(...) the omissions committed by the State place it among the legal persons (sujetos de derecho) whose combined acts constituted an accumulation of causes in producing the harm caused, which therefore entails joint and several liability (solidaridad en la responsabilidad) that they must necessarily assume for failing to perform their duties, particularly considering that those duties are preventive in nature, all pursuant to Article 1046 of the Código Civil, which applies supplementarily in this field by express provision of Articles 9 and 10 of the Ley General de la Administración Pública.
It follows from the foregoing that the Central Administration bears liability for the harm caused to the plaintiffs, which it shares with the INS and the Municipality; and even though a third party was involved, such involvement does not constitute a ground for exoneration (eximente) and, in any event, would be a mitigating factor, but not an element that entirely eliminates the State’s liability. Accordingly, the Tribunal correctly ruled in finding the appellant jointly and severally liable (solidaridad); therefore, the grounds asserted must be rejected.” (In this regard, see: SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA, decision number 308-F-2006 at 10:30 a.m. on May 25, 2006.) It is also important to note and emphasize what the same Sala Primera has stated regarding the fact that not every harm gives rise to an obligation to provide compensation, because the following elements must be present for that obligation to be enforceable: i) the harm must be certain, real, and actual; ii) there must be an injury to a legally relevant interest deserving of protection; and iii) there must be a causal relationship (relación de causalidad) between the conduct and the harm to property interests (daño en el ámbito patrimonial).
Each of the characteristics or requirements of compensable property damage (daño patrimonial y resarcible) is analyzed below on the basis of the events that occurred to the detriment of our client and the evidentiary support for the arguments and claims in this action, as follows: A.- Continuing causal relationship (relación de la causalidad permanente). It is a position shared in comparative law that the Administration’s property liability (responsabilidad patrimonial) cannot be declared when the harmful result is not the direct, exclusive, and necessary consequence of administrative action but, on the contrary, of the conduct or negligence of the injured party itself. It could not be otherwise, because if this is the determining prerequisite for the required causal nexus (nexo causal), the sole basis or foundation for the obligation to answer for or compensate the harm would therefore be absent.
Consequently, the Administration’s strict property liability (responsabilidad patrimonial objetiva) does not mean that the obligation to provide compensation arises whenever an injury is caused by the normal or abnormal operation of the Administration. Rather, it is necessary and essential that an objective causal nexus exist between the injury and such operation, without the injured party’s conduct playing a decisive role in this cause-and-effect relationship. Therefore, the success of the case at hand depends, to a large extent, on demonstrating not only the existence of the harm but also that it was caused by acts or omissions of the Administration. Although direct and conclusive evidence that would be difficult to obtain should not be required, it must nevertheless be possible, for purposes of assessing it and in accordance with the rules of rational judgment, to infer a precise connection between the two elements.
In the case before us, the causal nexus is clear, direct, and unmistakable, arising from the permit granted after the objective fulfillment of each and every regulated requirement—and even more—beginning from the premise of legitimate expectations (confianza legítima) based on the various authorizations, approvals, licenses, permits, and technical-administrative studies obtained for the construction and commissioning of the property belonging to INVERSIONES PELYO DEL ESTE S.A., for the sole and exclusive purpose of constructing and operating the ESTACION (sic) DE SERVICIO SERVICENTRO CORONADO. It should be noted that the harm caused arises from the Municipalidad de Vásquez de Coronado’s failure to recognize the scope and weight of the construction permit; worse still, the causal nexus is more than obvious, because it arises from the reliance placed by our client on the permits, authorizations, and approvals granted so that it could invest, in good faith, in constructing the ESTACION(sic) DE SERVICIO SERVICENTRO CORONADO.
Indeed, it should be noted that the diverse and wide-ranging set of technical-administrative procedures culminating in the construction permit forms the basis for the reliance and presumed legal certainty (seguridad jurídica) surrounding the investments made. Environmental matters that were duly resolved long ago, as confirmed and verified by officials of the defendant Municipality, cannot be used or invoked as an excuse. Nor does the filing of an action to declare an administrative act harmful to the public interest (proceso de lesividad) serve as an excuse for failing to lift a precautionary measure (medida cautelar) whose condition had been satisfied and whose principal proceeding concluded years ago; much less can it serve as an excuse or justification for failing to compensate the harm caused by the investments made by our client. Put differently, without A—permits, authorizations, and approvals—B—the construction of the project—would never have occurred.
B.- Absence of fault by the victim or self-benefit breaking the causal chain to the victim’s own detriment. As national and comparative legal scholarship has rightly insisted, the causal relationship is the objective or external nexus between a specific manifestation of the administrative function, whether by act or omission, and the unlawful injury (lesión antijurídica) caused to the private party subject to the Administration (administrado). Consequently, there must be an immediate, direct, and exclusive cause-and-effect relationship between the conduct of the administrative function and the unlawful injury caused to the private party, who must be compensated and has no legal or moral duty or obligation to bear the harm producing the unlawful injury. Based on the provisions of section 190, paragraph 1, of the LGAP, the exceptions or grounds excluding the causal nexus are established clearly and expressly.
For purposes of this section of the complaint, we will focus on fault by the victim (culpa de la víctima), understood as a form of personal responsibility, since it is premised on the private party having brought about the unlawful injury within its property or non-property sphere by committing a subjective fault that may have involved willful misconduct or negligence; the following forms should be highlighted: i) negligence, ii) recklessness, and iii) lack of skill. The classic example occurs when the victim participates in a public or collective demonstration that is both illegal and violent, resulting in harm to the victim as an effect of the necessary administrative intervention by the Fuerza Pública. Likewise, fault by the victim, as a ground for exemption from liability, must not be confused with concurrent fault or concurrent causes (concurrencia de culpas o de causas) affecting the extent and quantum of the compensation owed, since, in such a case, the compensation must be apportioned equitably insofar as the harm caused is strictly interconnected and relates to the same person whose assets were affected by that same concurrence of causes.
We must also identify two additional causes affecting the causal nexus: force majeure (fuerza mayor) and the act of a third party (hecho de un tercero). In the first case, force majeure concerns an event outside the sphere of activity of the acting Public Administration because it is unforeseeable and, if foreseeable, unavoidable. An act of a third party, for its part, concerns cases in which the unlawful injury is attributable to a legal person other than the acting Administration; this third party simultaneously breaks or severs the possibility of a causal nexus between the acting Administration and the affected person. None of these circumstances is present in this case, in which the damages claimed arise from the abusive and unlawful continuation of a precautionary measure suspending construction work (medida cautelar de suspensión de obras), as well as from the failure to recognize and implement the permits, authorizations, and approvals granted by the co-defendant administrations.
Likewise, in the case sub judice (sub exámine), our client had no involvement whatsoever in granting the permits or in the abusive and unlawful continuation of the precautionary measure suspending construction work when, to the contrary, all the conditions established for lifting it had already been fulfilled. This demonstrates the plaintiff’s good faith and reliance on the presumption of validity (presunción de validez) of the permits granted, including the construction permit, in proceeding with the investment—with the requisite causal nexus—in the construction and future operation of the ESTACION (sic) DE SERVICIO SERVICENTRO CORONADO. In addition to the foregoing, there are two grounds excluding the causal nexus, namely force majeure and the act of a third party. In the first case, this must be understood as an event outside the control of the acting Administration because it is unforeseeable or, although foreseeable, unavoidable.
An act of a third party, for its part, concerns those cases in which the unlawful injury is attributable to another person. This underscores a certain and objectively verifiable reality: none of the grounds exempting the Administration from property liability applies to this litigation, in which the damages claimed arise from the co-defendant Municipality’s abusive and unlawful continuation of a precautionary measure suspending construction work, as well as from the failure to recognize the permits, authorizations, and approvals granted on a concurrent, interrelated, and closely connected basis, to the detriment of the same person, namely the plaintiff. C.- Certain, quantifiable, and individualized harm. Another constituent element of the Administration’s property liability lies—as bears repeating—in the existence of actual or certain harm (daño efectivo o cierto) that is also economically assessable and individualized in relation to a specific person and necessarily derives from the normal or abnormal operation of public services and functions.
It could not be otherwise, because the unlawful injury must be compensable or capable of giving rise to the obligation to compensate the affected person pursuant to section 196 of the LGAP. Indeed, it has been widely accepted that the Public Administration, in all its spheres, is required to compensate any injury suffered by private parties to their property and rights, even if it results from the normal operation of public services, provided that the loss suffered by the private party is individualized and specific and also exceeds what may be regarded as the common burdens of social life, such as so-called urban-planning burdens (cargas urbanísticas). Likewise, only harm that occurs in a real and actual manner is understood to be compensable, unlike potential, hypothetical, or speculative circumstances. It is therefore appropriate to reiterate that one of the requirements for the Administration’s property liability and for any claim for damages lies in the harm’s material actuality and its certain and real nature, making it economically quantifiable in relation to a particular affected person or clearly identifiable group.
We shall now summarize the characteristics of what is understood as compensable harm (daño resarcible)—without detracting from the foregoing emphasis—which must be: 1. Actual or certain: it cannot be merely potential, hypothetical, or conditional. 2. Economically assessable: it must be expressible or quantifiable in monetary terms. 3. Individualized: with respect to a person or group of persons. In this regard, the SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA has held: “(...) VI.- Not every harm gives rise to the obligation to provide compensation. For that purpose, the following characteristics must essentially be present for it to constitute ‘compensable harm’: A) It must be certain, real, and actual, and not merely potential or hypothetical; it cannot be based on assumed or conjectural events.
The damage does not lose this characteristic if its quantification is uncertain, indeterminate, or difficult to assess or prove; nor should certainty be confused with present occurrence, since compensation for certain but future damage is permissible; likewise, certainty should not be confused with present occurrence, since compensation for certain but future damage is permissible; similarly, future damage should not be confused with lost profits (lucro cesante) or consequential loss (perjuicio), since the former refers to damage that arises as a necessary consequence of the causal event or event giving rise to the damage, that is, its repercussions have not materialized when the proceedings are instituted. As regards the magnitude or amount (seriousness) of the damage, this is a matter solely within the subjective purview of the injured party; however, the law cannot entertain claims based on insignificant damage arising from excessive sensitivity.
In any event, the project has already been thwarted and the investment lost, thereby giving rise to objective, identifiable, certain, and quantifiable damage that must be compensated, since the sole purpose for which the property was acquired was the construction and operation of a service station, as stated.” In its conclusions, the plaintiff reiterates what was stated in the complaint and confirms the liability of the Municipalidad de Vásquez de Coronado. It introduces new matters relating to the liability of SETENA and Senara.
In responding to this complaint, the State’s representative stated, insofar as relevant: “(...) LEGAL REASONS AND GROUNDS (...) The claims asserted by the plaintiff against the State are inconsistent, inadmissible, and unfounded. Consequently, they must be dismissed for the following reasons: DEFENSES: • LACK OF PASSIVE STANDING AD CAUSAM, LACK OF A LEGAL RIGHT, AND STATUTE OF LIMITATIONS. • To establish the existence of potential financial liability on the part of the Administration, three basic prerequisites must necessarily be present, without which such liability cannot be recognized: I. The existence of an act or omission by a public entity. II. The occurrence of harm that the injured party has no duty to bear and that is actual, real, economically assessable, and individualized. III. The existence of a causal link between the administrative act or omission and the harm inflicted; that is, a direct cause-and-effect relationship between the alleged event and the resulting harm.
Regarding the first prerequisite—an act or omission by the State—the State has at no time taken any action or omitted anything that caused any economic harm or loss to the plaintiff company. In this regard, as has been stated from the outset and will be explained further, the party itself openly acknowledged that SETENA and the other competent authorities, namely the DGTCC, ‘have made clear their favorable position toward the project’ (section of the complaint entitled ‘BACKGROUND’). In other words, the claimant expressly acknowledges that the conduct of the State has not endangered or even threatened its project. As for the occurrence of harm, no such harm exists and, in any event, it is not the responsibility of the State, because the conduct ultimately challenged is attributable solely to the Municipality of Vásquez de Coronado (act of a third party)—as we will explain below. Thus, clearly, there is no causal link either.
The factual scenario presented by the plaintiff lacks the essential elements of administrative liability, namely the existence of a causal link or causal relationship, which constitutes the ‘bridge’ between the administrative conduct and the resulting harm, that is, between the Administration and the person subject to its authority. As noted above, it bears repeating that the plaintiff expressly acknowledges that the administrative conduct of my Client was ‘Favorable to the project.’ In this context, pursuant to section 190 of the Ley General de la Administración Pública, those prerequisites have no factual or legal basis upon which liability may be imputed to the State; therefore, there is no State liability. In any event, without prejudice to the foregoing, the involvement of a third party is evident with respect to the aforementioned Municipality, which, as will be explained, is the entity vested with the constitutional and legal authority ultimately to grant building permits (licencias constructivas), suspend them, or renew them.
Insofar as relevant, that article provides: ‘1. The Administration shall be liable for all harm caused by its lawful or unlawful, normal or abnormal operation, except in cases of force majeure, fault of the victim, or an act of a third party. ’ (Emphasis added). Accordingly, if any of the grounds set forth in the preceding provision is present, the causal link is broken and, consequently, the Administration’s liability is extinguished. Thus, the plaintiff’s spontaneous admission that my Client’s conduct was ‘Favorable to the project,’ unlike the Municipality’s conduct (the interim measure (medida cautelar) and the injuriousness proceeding (proceso de lesividad)), clearly demonstrates that the State is exempt from liability (act of a third party), insofar as it did not cause the hypothetical harm attributed to it. Along these lines, the claimant expressly states: ‘Note that the harm caused derives from the Municipality of Vásquez de Coronado’s disregard for the scope and weight of the building permit (...) nor does the filing of an injuriousness proceeding serve as an excuse [sic] for failing to lift an interim measure (...) much less can it serve as an excuse or justification for failing to compensate for the harm caused by the [sic] investments made by our client (...) the damages claimed derive from the abusive and unlawful continuation of an interim measure suspending the work by the co-defendant Municipality, as well as its disregard of the permits, authorizations, and approvals granted in a concurrent, interrelated, and closely connected manner (...) For present purposes, the resulting adverse effect is clearly individualized, quantifiable, and certain, rather than hypothetical or potential, because the harm has occurred, construction of the project has been suspended, and its future completion and commencement of operations are now radically uncertain by virtue of the abusive and unlawful continuation of the interim measure and the outcome of the injuriousness proceeding brought by the co-defendant Municipality under court case number 15-10009-I027-CA.’ (sic) Furthermore, the plaintiff requests that my Client be held strictly liable, as stated in numbered claim 2; however, the fact remains that the plaintiff has not identified a single act or omission on our part that could have caused it harm or loss, which, it bears noting, does not exist in any event.
The foregoing is reinforced by numbered claim 3, in which it seeks compensation for non-pecuniary harm from the Municipality, expressly stating that this is requested ‘because this Municipality persisted in continuing the initially adopted interim suspension measure, despite the existence of internal technical and legal opinions from the Municipality itself that did not support the indicated suspension (...)’ (sic) That is, if we compare the two claims, number 2 lacks a factual basis, unlike the claim asserted against the local government. It is therefore clear that the acts the plaintiff considers allegedly harmful are solely those of the Municipality. o Regarding municipal powers over land-use certificates (certificados de uso de suelos) and building permits: As is well known, in local urban-planning and environmental matters, the Municipalities have exclusive authority to issue building permits and, therefore, also to maintain and suspend them.
This is pursuant to the provisions of the Constitución Política itself and the other related laws. Along these lines, the Sala Constitucional has stated: ‘municipal corporations play a leading role in protecting and conserving groundwater through a series of indirect instruments. Thus, the Ley de Planificación Urbana (No. 4240 del 15 de noviembre de 1968), enacted more than 35 years ago on the basis of section 169 of the Constitución Política—insofar as they are responsible for administering local interests and services in each Canton—imposed on them the duty to enact a master plan (plan regulador) to plan and control urban development and the related urban-development regulations (articles 15 and following). Within that master plan and the zoning regulations, Municipalities must identify, for purposes of regulating, controlling, and restricting human activities (industrial, urban-development, agricultural and livestock activities, etc.), those areas or zones designated as protected because an aquifer or its recharge or discharge area is located therein.
By application of the fundamental rights to a healthy and ecologically balanced environment (article 50 of the Constitución Política), to human life and health (article 21 thereof), and in the interest of sustainable development, cantons whose geomorphological characteristics mean that their territory includes land containing aquifers, their recharge and discharge areas, water sources, and springs (nacientes) are particularly called upon and required to regulate such matters responsibly, efficiently, and effectively, since groundwater sometimes supplies not only the consumption and use needs of the canton’s population but also those of several cantons, demonstrating a clear supra-local or national interest. The inhabitants of those localities, for their part, must bear the general burden or the limitations and restrictions on the use and exploitation of land and water arising from the determination and designation of such protected areas, because this benefits them, the inhabitants of other cantons supplied by the waters flowing through the aquifer and emerging or discharging in other cantons, and, of course, future generations.’ (Voto N° 2004-01923 de las 14 horas con 55 minutos del 25 de febrero del 2004).
Likewise, this Procuraduría General de la República has issued opinions clarifying the authority of local governments: ‘urban-planning functions include the preparation and approval of the master plan and supplementary regulations, such as the Reglamento de Zonificación, Reglamento de Fraccionamiento y Urbanizaciones, Mapa Oficial and Reglamento de Renovación Urbana; the granting of subdivision (fraccionamiento), urban-development, and construction permits; as well as sanctioning authority (Ley de Planificación Urbana, artículos 15, 16 21, 24, 32; Ley de Construcciones, artículos 151 87-89 y 96).’ (Dictamen C-001-2013 del 9 de enero del 2013). Within the framework of these powers, the co-defendant Municipality, through resolution N° 2015-253-36 adopted at ordinary session N°253 del 23 de febrero de 2015, resolved to declare the land-use certificates related to this matter injurious to the public interest and filed injuriousness proceeding N° 15-010009-1027-CA before the Tribunal Contencioso Administrativo, Sección Segunda, against the plaintiff in these proceedings.
By judgment N° 20-2018-11 de las 10 horas y 30 minutos del 23 de marzo del 2018, the following was decided: ‘OPERATIVE PROVISIONS (POR TANTO) The defense of lack of a legal right is denied. The complaint filed is granted. Consequently, the following administrative acts are declared absolutely null and void: a) Certificado de Zona N° CZDIM-785-05 de fecha 6 de octubre del 2005 del Departamento de Ingeniería Municipal. b) Certificado de Zona N° 884-07 de fecha 11 de setiembre del 2007 del Departamento de Ingeniería Municipal c) Certificado de Zona No 553-11, de fecha 10 de junio del 2011 del Departamento de Planificación Urbana y Control Urbanístico. d) Certificado de Zona N° 554-11 de fecha 10 de junio del 2011. e) Permiso de Construcción N° 039.2012 de fecha 15 de marzo del 2012 del Departamento de Ingeniería Municipal or Certificado de Zona N° 552-12, de fecha 15 de marzo del 2012 del Departamento de Planificación Urbana y Control Constructivo.
Both categories of costs in this action shall be borne by the defendant.’ (sic) In reaching this conclusion, the Tribunal Contencioso determined that the aforementioned land-use certificates contained a defect in their grounds (motivo), because they had been issued contrary to the provisions of the master plan. It stated: ‘V- Now, regarding the merits of the matter submitted for consideration, the Court finds that, as asserted by the plaintiff Municipality, the land-use certificates challenged in this proceeding do indeed contain a defect in the element of their grounds, specifically in the legal basis applied to the activity requested by the defendant company.
Note that Article 21 of the Regulatory Plan (Plan Regulador) of the canton of Vásquez de Coronado is absolutely clear in providing that the operation of a service station is a permitted use strictly within the Linear Commercial and Services Zone of San Antonio, which extends along Route 102, from the La Trinidad-San Antonio intersection to San Isidro de Coronado. The provision is self-sufficient in its plain wording, and the operation of a service station is not included as a permitted use in any other zone under the aforementioned Regulatory Plan. Consequently, there were no grounds whatsoever for deeming the land use (uso de suelo) for operating a service station compliant in a property located within a zone where that use was not permitted. In this regard, it is undisputed that property registration number 569222-000 in the province of San José, according to its cadastral plan (plano catastrado) N°SJ-1021582-2005, is located in the zone described by the Regulatory Plan as the Linear Low-Intensity Residential, Services, and Commercial Zone, governed by Article 20 of the aforementioned regulations.
Under that provision, the permitted uses in that sector are: public services, private services, single-family residences; multi-family residences; resturants [sic], small-scale artisanal industry, general commerce, automobile parking structures, parking lots, hotels, community facilities, and supermarkets. Note that use for the operation of a service station is not included among the uses expressly provided for that zoning designation and, therefore, is automatically [sic] deemed a prohibited use, as established by Article 3.2.1 of the Regulatory Plan, which provides in this regard that “any use not included in the feast of permitted and conditional uses shall be understood as not permitted in that zone.” It should be noted that it was likewise impermissible to engage in an interpretive exercise to include service stations within the indeterminate concept of “general commerce,” because the former had been expressly reserved for another physical area specifically designated for that purpose.
Consequently, the competent municipal official who issued the compliant land-use certificates in this specific case improperly applied the applicable legal provision, which under our administrative legal system constitutes a serious defect (vicio grave) affecting the grounds (motivo) and, derivatively, the substance (contenido) of the challenged acts; consequently, it renders them absolutely null and void (nulidad absoluta), pursuant to Articles 132, 133, 158, 166 and 172 of the Ley General de la Administración Pública, as is hereby declared in this injuriousness proceeding (proceso de lesividad)” (sic). The Tribunal’s ruling is significant because the plaintiff’s actions seek to assign liability to my Client that does not belong to it, when the matter at issue is plainly within municipal jurisdiction, particularly because, in urban-planning and environmental matters, the Municipality has final authority to approve or reject a construction project, while SETENA and the DGTCC merely participate in a preliminary procedure in which the municipal entity has the final say.
Thus, in exercising its authority, the Municipalidad de Vásquez de Coronado initially issued the land-use certificates that authorized the plaintiff’s construction permit and later determined that those certificates were null and void, as the Tribunal also declared. All of the foregoing confirms that this local entity is responsible for granting or denying the plaintiff the subjective right (derecho subjetivo) relating to the construction work, not my Client. In accordance with the foregoing, it is also worth noting, with respect to the environmental feasibility approval (viabilidad ambiental) issued by SETENA, that its issuance alone does not authorize the performance of the activity, work, or project; rather, it is a prerequisite for issuance of the final act (acto definitivo), which is the act authorizing performance of the work. Thus, processing environmental feasibility approval or an environmental license (licencia ambiental) forms part of the principal authorization process.
In this regard, the Sala Constitucional has stated: “It must also be cautioned that the preparation and approval of the environmental impact study (estudio de impacto ambiental) does not, in itself, entail placing the project in question into operation, because it is merely one of the requirements imposed to complete the authorization process, which in some cases will include obtaining a health permit, approval of the development plans by the respective municipality, approval of the concession by the competent entity, issuance of business licenses, etc. This is so because, in environmental matters, one cannot speak of immutable variables; on the contrary, by its very nature, the environment is itself subject to change, to an even greater degree through human intervention. Approval of an environmental impact study under the terms established by the Ley Orgánica del Ambiente likewise does not constitute an immutable authorization to carry out a specific human project, because through the supervisory work entrusted to the Administration, when environmental damage is detected as established by the Convención de Río, the permit may be revoked in order to guarantee the right established in Article 50 of the Constitución Política and, at the same time, enforce the environmental guarantee provided to safeguard the implementation of environmental corrective, mitigation, or compensation measures for environmental damage or uncontrolled adverse environmental impacts caused by the activity, works, or projects.” (Voto N° 2019-2009 of 14 hours and 55 minutes on 11 de febrero del 2009, considering clause (considerando) VI).
(Boldface does not appear in the original). SETENA Resolution N° (sic) was nothing more than an “environmental license for applying for the remaining permits from the competent authorities.” (Sala Constitucional, Voto N° 17237-2010, considering VIII). Furthermore, with respect to the DGTCC, report N° DGTCC-DL-84-2018 of 20 de marzo de 2018 (attached) stated that this body had informed SETENA and the Municipalidad de Vásquez de Coronado that they were required to consider the matter as appropriate in exercising their respective powers, and that, as far as the DGFCC was concerned, there was no procedural act (acto de trámite) still to be completed by the developer concerning technical compliance by the approved project, which, from an engineering standpoint, complied with all the technical specifications of Decreto Ejecutivo número 30131-MINAE Reglamento para la Regulación del Sistema de Almacenamiento y Comercialización de Hidrocarburos.
Through the foregoing, my Client complied with the order in constitutional judgment N° 2013-2023 of 14 hours and 30 minutes on 13 de febrero del 2013 (Article 13 of the Ley de la Jurisdicción Constitucional), the operative portion (parte dispositiva) of which ordered it to: “(...) immediately undertake the corresponding actions, within their respective areas of authority, to ensure that construction work on the service station of [...] SA. does not continue and that its actual operation is not permitted until the necessary measures have been adopted to rule out the risk of contamination of aquifers or groundwater (...).” (sic). In other words, neither SETENA nor the aforementioned DGFCC engaged in conduct that could have caused the alleged damage now being attributed to them. It should also be noted that, in any event, the actions taken by my Client—which have not been challenged in this proceeding and plainly cannot be challenged here—and which, it bears repeating, have no connection to the alleged damage, occurred more than five years ago (Article 198 of the Ley General de la Administración Pública).
> INADMISSIBILITY OF THE DAMAGES CLAIMED. In accordance with the foregoing and pursuant to Articles 190 et seq. of the LGAP, we reject the plaintiff’s claim seeking to impose upon us payment for property damage (daño patrimonial) and consequential losses (perjuicios). Without prejudice to the foregoing, the following is added:
Regarding the property damage claimed: The plaintiff requests that the judgment award it the exorbitant sum of ochocientos cuatro millones ciento cincuenta y un mil setecientos quince colones (¢804.751.715,00), based on a private report submitted with its complaint. First, that report is nothing more than a private document prepared by Ing. Adolfo Lobo Zamora at the plaintiff’s express request for submission as evidence in this proceeding (note that it is addressed to the plaintiff); it is therefore rejected. Without prejudice to the foregoing, the State caused no property damage whatsoever (Article 317 of the Código Procesal Civil). Furthermore, it is entirely improper for the plaintiff to seek an order requiring the State to pay the full value of the property (which is wholly inadmissible) while also seeking to retain possession and ownership thereof. Additionally, the Tribunal should note that the matter referred to by the plaintiff in this case is the construction of a service station and that, under the municipal regulations, an interim measure (medida cautelar) was issued suspending the permits for that particular use.
This is entirely clear from the aforementioned judgment N° 20-2018-11 of 10 hours and 30 minutes on 23 de marzo del 2018, issued in injuriousness administrative-litigation proceeding (proceso contencioso de lesividad) N° 15-010009-1027-CA: “V. (..) Note that use for the operation of a service station is not included among the uses expressly provided for that zoning designation and, therefore, is automatically [sic] deemed a prohibited use, as established by Article 3.2.1 of the Regulatory Plan, which provides in this regard: ‘Any use not included in the list of permitted and conditional uses shall be understood as not permitted in that zone’ (...)” (sic). The State is not depriving the plaintiff of its right to private property (Article 45 of the Constitución Política), particularly because even the interim measure was imposed not by the State, but by the Municipality sued herein. Accordingly, the claim for compensation is manifestly inadmissible because the State is not responsible for the alleged restriction of the plaintiff’s property right, since territorial planning and control fall within municipal authority. For the foregoing reasons, the request that the State be ordered to pay ochocientos cuatro millones ciento cincuenta y un mil setecientos quince colones (¢804.751.715,00) must be denied.
• Regarding the consequential losses claimed: The plaintiff also requests that the judgment order the State to pay consequential losses in the amount of doscientos diez millones seiscientos setenta y nueve ciento cuarenta y dos colones (¢210.679.142,00), understood as amounts not received, equivalent to the returns that would have been earned if the amount actually spent had instead been invested in six-month debt securities issued by Banco Nacional de Costa Rica, likewise according to the private report prepared by Ing. Adolfo Lobo Zamora. First, we reiterate the points made in the preceding section, insofar as this is a private study paid for by the plaintiff itself for submission with the complaint. The plaintiff then bases that amount on a calculation of interest allegedly not received, using the rates applicable to six-month certificates issued by Banco Nacional de Costa Rica, which is hereby rejected.
Note that the report on which the calculation is based relies on hypotheses and assumptions; for example, it states that the consequential losses arise from the sunk cost (costo hundido) of the land, indicates that its possible alternative use and potential return should be evaluated, and states that the most prudent option would have been to invest the money in a bank’s securities. Thus, what the plaintiff ultimately seeks is for us to bear the cost of an alleged investment that it would have made, which is rejected (Article 196 of the Ley General de la Administración Pública).
In any event, this Representation opposes the claim for interest sought and reiterates that no damage exists and that any award in that regard against the State must be denied. Accordingly, the pecuniary losses (perjuicios patrimoniales) of two hundred ten million six hundred seventy-nine one hundred forty-two colones (¢210.679.142,00) must meet the same fate, and their complete denial must be ordered. • Regarding the legal interest and indexation sought: This Representation opposes the claim for legal interest (intereses legales) and indexation (indexación) sought and reiterates that no loss or damage exists and that any award in that regard against the State must be denied. • Regarding costs (costas): Because the action against the State is entirely without merit, the plaintiff must be ordered to pay costs, as will be expressly requested below.” In its closing arguments, it reiterates the foregoing and refers to the file of the Municipalidad de Vásquez de Coronado, the private expert reports and their inadmissibility, and the lack of a causal nexus (nexo causal).- The representative of SENARA, for his part, stated in summary that they merely provided the corresponding technical opinions regarding the hydrogeological conditions of the site.
SENARA is not the entity that issues construction permits or approves projects’ environmental feasibility (viabilidad ambiental). What SENARA issued in official letter ASUB-363-O6 was an assessment of the hydrogeological conditions of the site, so that the project developer would incorporate the appropriate design precautions and technology to ensure that the project would neither endanger nor affect the aquifers (mantos acuíferos), and would adopt measures to prevent the project from adversely affecting public interests. He states that the judgment granting relief (sentencia estimatoria) issued by the Sala Constitucional found that the plaintiff company had failed to take the appropriate precautions to protect the water resource (recurso hídrico) (which SENARA had assessed through official letter ASUB-363-06 of 4 de setiembre del 2006), carrying out excavations beyond the permitted extent and reaching the aquifer itself, leaving it exposed; therefore, the Sala Constitucional ordered the project developer to close the pit that was causing the environmental damage (daño ambiental).
In its closing arguments, SENARA’s representation contends that SENARA’s liability was not established, distinguishes the respective responsibilities, and sets forth a statement of proven and unproven facts.- For its part, the Municipalidad de Vásquez de Coronado stated in its answer: “(...) LEGAL CONSIDERATIONS. Regarding environmental protection as a cross-cutting principle of Costa Rican public law. Our country’s administrative legal system has established the so-called preventive and precautionary principles (principios preventivo y precautorio) as a central pillar governing administrative conduct, concerning which there are countless pronouncements by technical advisory bodies. ‘...the preventive principle, which is of paramount importance in this field and must not be confused with the precautionary principle, under which a form of presumption in favor of the environment is established, such that, where there is no scientific certainty regarding the adverse effects that an action might cause, the action is prohibited, restrictions are imposed upon it, or protective measures are adopted.
Both are stated in article 11 of the Ley de Biodiversidad: “The criteria for applying this law are: 1.- Preventive criterion: It is recognized as vitally important to anticipate, prevent, and address the causes of biodiversity loss or threats thereto. 2.- Precautionary criterion or in dubio pro natura: Where there is a danger or threat of serious or imminent harm to elements of biodiversity and the knowledge associated with them, the absence of scientific certainty shall not be used as a reason to postpone the adoption of effective protective measures.(...)”’ And they are closely related: ‘The Prevention Principle is said to apply in cases where it is scientifically possible to measure risks and, accordingly, to recommend measures for managing them. When scientific knowledge does not reach that level, the appropriate course is to invoke the Precautionary Principle.(...).’ The preventive principle relates to the character that actions for environmental protection must generally have: ‘(...) Prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources.
Consequently, the guiding principle of prevention is based on the need to take and implement all precautionary measures necessary to avoid or contain possible harm to the environment or human health.’ (Sala Constitucional, Vote No. 1250 issued at 1 1:24 hours on 19 de febrero de 1999, reiterated in Votes numbers 2219 issued at 15:18 hours on 24 de marzo de 1999, 9773 issued at 9:44 hours on 3 de noviembre del 2000, 1711 issued at 16:32 hours on 27 de febrero del 2001, 6322 issued at 14.14 hours on 3 de julio del 2003 and 1923 issued at 14:55 hours on 25 de febrero del 2004).’ (See, to this effect, Legal Opinion No. OJ-01 1-2006, dated 30 de enero del 2006, issued by the Procuraduría General de la República). The legal basis for these doctrines is found in the Ley de Biodiversidad, No. 7788, of 30 de abril de 1998, which provided: ‘ARTICLE 1.- Purpose. The purpose of this law is to conserve biodiversity and ensure the sustainable use of resources, as well as to distribute the resulting benefits and costs fairly.
(...) ARTICLE 5.- Interpretive framework. This body of law shall serve as the framework for interpreting all other provisions governing the subject matter of this law. (...) ARTICLE 11.- Criteria for applying this law. The criteria for applying this law are: 1.- Preventive criterion: It is recognized as vitally important to anticipate, prevent, and address the causes of biodiversity loss or threats thereto. 2.- Precautionary criterion or in dubio pro natura: Where there is a danger or threat of serious or imminent harm to elements of biodiversity and the knowledge associated with them, the absence of scientific certainty shall not be used as a reason to postpone the adoption of effective protective measures. 3.- Environmental public-interest criterion: The use of elements of biodiversity must safeguard the development options of future generations, food security, ecosystem conservation, the protection of human health, and improvement of citizens’ quality of life. 4.
Integration criterion: The conservation and sustainable use of biodiversity must be incorporated into sectoral and intersectoral plans, programs, activities, and strategies so that they are integrated into the development process. (...) ARTICLE 45.- Responsibility for environmental safety. The State has an obligation to prevent any risk or danger threatening the continued existence of ecosystems. It must also prevent, mitigate, or remedy environmental damage that threatens life or diminishes its quality. (...)’ For its part, the Ley Orgánica del Ambiente (Law No. 7554 of 4 de octubre de 1995) provides, insofar as relevant here, as follows: ‘ARTICLE 1.- Objectives. This law shall seek to provide Costa Ricans and the State with the instruments necessary to achieve a healthy and ecologically balanced environment. Through the application of this law, the State shall defend and preserve that right in pursuit of greater well-being for all inhabitants of the Nation.
The environment is defined as the system comprising its various natural elements and their interactions and interrelationships with human beings. ARTICLE 2.- Principles. This law is guided by the following principles: a) The environment is the common heritage of all inhabitants of the Nation, subject to the exceptions established by the Constitución Política, international agreements, and laws. The State and private parties must participate in its sustainable conservation and use, which are matters of public utility and social interest. b) Everyone has the right to enjoy a healthy and ecologically sustainable environment in which to develop, as well as the duty to preserve it, pursuant to article 50 of our Constitución Política. c) The State shall ensure the rational use of environmental resources in order to protect and improve the quality of life of the inhabitants of the national territory.
It is likewise required to promote economically and environmentally sustainable development, understood as development that satisfies basic human needs without compromising the options of future generations. d) Any person who pollutes or damages the environment shall be liable in accordance with the laws of the Republic and applicable international agreements. e) Harm to the environment constitutes an offense of a social nature because it affects the foundations of society’s existence; of an economic nature because it threatens the materials and resources essential to productive activities; of a cultural nature because it endangers communities’ way of life; and of an ethical nature because it threatens the very existence of present and future generations. Through its institutions, the State shall promote the implementation of an information system containing environmental indicators intended to measure their development and correlation with the country’s economic and social indicators.
ARTICLE 3.- Joint participation in achieving objectives. The Government shall establish a coordinated and interrelated set of objectives aimed at improving the environment and properly managing natural resources. These objectives shall incorporate specific decisions and actions intended to achieve them, supported by rules, institutions, and procedures that enable those policies to function effectively. ARTICLE 4.- Purposes. The purposes of this law are: c) To promote the efforts necessary to prevent and minimize harm that may be caused to the environment. d) To regulate individual or collective human conduct and public or private activity concerning the environment, as well as the relationships and actions arising from environmental use and conservation. e) To establish the principles governing the activities of the Public Administration in environmental matters, including coordination mechanisms for efficient and effective work.
(...) ARTICLE 59.- Environmental pollution (contaminación del ambiente). Pollution means any alteration or modification of the environment that may harm human health, threaten natural resources, or affect the Nation’s environment generally. The discharge and emission of pollutants must comply with the technical regulations issued for that purpose. The State shall adopt the measures necessary to prevent or correct environmental pollution. ARTICLE 60.- Prevention and control of pollution. To prevent and control environmental pollution, the State, the municipalities, and other public institutions shall give priority, among other matters, to establishing and operating adequate services in areas essential to environmental health, such as: a) The supply of water for human consumption. b) The sanitary disposal of excreta, wastewater, and stormwater. c) The collection and management of waste. d) The control of air pollution. e) The control of noise pollution. 0 The control of chemical and radioactive substances.
These services shall be provided in the manner prescribed by specific laws and regulations, while seeking the participation of the public and its organizations. ARTICLE 61.- Environmental contingencies.
The competent authority shall order the necessary preventive and corrective measures when contingencies arise due to environmental pollution and other circumstances not contemplated in this law.” It is thus more than evident that the national legal system is highly protective with respect to safeguarding the Nation’s natural resources. It establishes the possibility that executive bodies, and even more so judicial bodies, may adopt protective positions regarding various legally protected environmental interests. In relation to the foregoing, the right to health is a fundamental right derived from Article 21 (right to life) and Article 50 (right to a healthy and ecologically balanced environment) of our Political Constitution. The conceptualization of the Right to Health in our case law and that of the WHO (World Health Organization) has defined this fundamental Right as follows: “a state of complete physical, mental, spiritual, emotional, and social well-being, and not merely the absence of ailments or diseases.” As follows from the foregoing concept, the right to health goes beyond simply being free from diseases that impair one’s physical condition; the concept encompasses emotional and social well-being, which is unquestionably closely related to the protection that public institutions can provide to environmental elements such as water and water resources in general.
It should be recalled that, as Costa Ricans, our emotional and social health may be impaired when we are placed in a state of constant uncertainty regarding the potential harm that our vital ecosystem may suffer. Focusing now on one of the key issues, a right from which the right to Health is derived and which is regulated by Article 50 of our Constitution, we have the right to a healthy and ecologically balanced environment, from which two important principles arise: the Precautionary Principle (Principio Precautorio) and the Preventive Principle (Principio Preventivo). These principles were applied by the Constitutional Chamber in the ruling ordering the suspension of the works, which remains in force to date because we have not been notified of any judicial ruling to the contrary. These considerations are intertwined with the legal certainty (seguridad jurídica) that every legal system must provide to those who resort to the courts to enforce their rights.
This occurred through judgment no. 2013-2023, at 14:30 on February 13, 2013, issued by the Constitutional Chamber. In that judgment, the Constitutional Chamber ordered the suspension of the works through a measure typically defined as a provisional decision adopted to prevent serious and irreversible harm to the petitioner and, in this case, to the diffuse rights (derechos de contenido difuso) it sought to protect. It should thus be recalled that, under our legal system, the proper combination of Articles 11, 33, 39, 41, 49, and 153 of the Political Constitution establishes the existence and content of the right to effective judicial protection (tutela judicial efectiva), a complex right manifested, among many other ways, in the ability to access the courts, obtain a well-founded decision from a Judge predetermined by Law, and have the resulting ruling enforced adequately and within a reasonable time.
To the foregoing must be added, as part of that range of protections, the right to equally effective interim relief (tutela cautelar). This fundamental right undoubtedly guarantees more than the decision-making authority to declare what is legally due, since such protection does not exist without the actual realization of what has been granted in the judgment, and that realization cannot be achieved unless the precise measures, guarantees, or safeguards needed to ensure the effectiveness of the ruling are adopted. This is precisely the type of measure adopted by the Constitutional Chamber itself in the aforementioned ruling. The effectiveness attributed to judicial protection requires recognition not only of the abstract right of action, but also of the right to have the judicial ruling satisfy the petitioner’s claim. In this case, that claim was closely related to the protection of environmental rights, for which broad standing in defense of diffuse interests is recognized.
Regarding the proceeding for annulment of the Administration’s own acts (anulación de los actos propios) and due process (debido proceso), including the interested party’s right of defense. The plaintiff maliciously asserts that this representation, either tacitly or expressly, acknowledges any damages and losses by virtue of the proceeding to declare the act harmful to the public interest (proceso de Iesividad) that was initiated; the correct statement is that this Municipality initiated a proceeding governed by the legal system to review its own actions. It should be recalled that liberal democratic legal systems base their validity on the established principle of legal certainty, which means, first and foremost, that Public Administrations must provide a regulatory framework so that citizens know what to expect in their dealings with the Administration. In its strict sense, this framework need not have any particular content; the existence of a body of provisions establishing the legal consequences of certain facts or acts is sufficient.
The constitutional status of legal certainty and of consistency in the exercise of the powers granted to the Public Administration is undeniable, given the significance of those values within the Costa Rican legal system and their importance in guaranteeing peace and social harmony. Accordingly, legal certainty, as a fundamental value of the legal system framed within a social system that seeks a logical and consistent public administration, encompasses and permeates all legal relationships entered into by the various parties as a consequence of exercising their fundamental rights. The distinguished constitutional scholar Antonio Enrique Pérez Luño, in his work La Seguridad Jurídica, Barcelona, Editorial Ariel S.A., 1991, page 19, states the following: “Under the direct influence of contractualist and Enlightenment philosophy, security would become an indispensable prerequisite and function of the legal systems of States governed by the rule of law.
It has correctly been observed that legal certainty is the primary factor that drove human beings to establish a society and a system of Law or, stated in rational terms, that which constitutes the fundamental and primary rationale of the legal order.” According to this view, legal certainty goes one step beyond the specific values established in the Constitution and becomes an overarching principle for achieving constitutional values by fostering the entire constitutional order, which ensures the realization of individual freedoms. It clearly follows from the foregoing that legal certainty is a principle of very broad scope that informs the entire legal system and from which other principles derive, such as the protection of citizens’ legitimate expectations (confianza de los administrados) and consistency in State administration. It should be borne in mind that our argument is not intended to suggest that legal certainty entails the petrification of the legal system or that powers should not be updated and assigned differently from the manner already established.
Rather, it seeks respect for the guarantees of trust, certainty, efficiency, consistency, and sound public administration, so that powers correspond to the technical and specialized work of each institution and so that, if the legal system is changed, such change is implemented generally, guaranteeing the equality of citizens before the legal system and not establishing individual exceptions to legal rules. Precisely in keeping with the foregoing, it should be recalled that the principle prohibiting singular derogation from regulations (principio de inderogabilidad singular de las normas) remains in force, meaning that a regulation is binding even upon the entity that issued it. This in no way means that regulations cannot be amended or changed; rather, it guarantees that any possible or hypothetical change or amendment must be made in accordance with the procedures established for that purpose and must apply generally to all citizens, thereby preventing discretionary reservations allowing rules to be disapplied in specific cases.
Notwithstanding the foregoing, the legal system itself provides for the possibility of an exception to that principle because human activity may involve failures, errors, or underlying problems, and administrative management does not escape such vicissitudes. Legal systems therefore provide for the possibility that administrative acts (actos administrativos) favorable to third parties or declaring rights in their favor may be annulled or reviewed ex officio (de oficio). In this regard, our legal system establishes a two-track system of proceedings for annulling the Administration’s own acts, specifically as provided in Article 173 of the General Law of Public Administration and Article 34 of the Code of Administrative Procedure. These provisions constitute a guarantee for citizens insofar as, if they are beneficiaries of an administrative act, it will not be revoked without a prior proceeding affording all due-process guarantees: either an administrative proceeding—subject to a prior favorable opinion from an advisory body, PGR or CGR, as applicable—in the circumstance contemplated by Article 173, or a judicial proceeding in the case of Article 34.
Accordingly, as a general principle, the Public Administration is barred from annulling its own acts issued in favor of citizens. Likewise, both annulment proceedings have their own order of precedence, such that, as a general rule, any action must proceed through the judicial courts by requesting that the judicial body declare the act alleged to be harmful null and void. The reason for limiting the Administration’s ability to annul its own acts is legal certainty, since the intent is to assure citizens that administrative acts conferring subjective rights (derechos subjetivos) upon them will not be arbitrarily modified or rendered ineffective by the Administration itself. In our particular case, it is important to note that, unusually within the sphere of Costa Rican public law, our Municipality declared one of its actions harmful to the public interest (Iesividad), in full application of the principle of legal certainty and in an effort to avoid creating greater expectations for the interested party.
In that proceeding, initiated under judicial case file no. 15-010009-1027-CA, our Municipal Corporation, in a sound exercise of diligence, proceeded to issue the declaration of harmfulness to the public interest and file the judicial action, in which the plaintiff herein participated, to determine the potential nullity of an action. In that proceeding, the Municipality is not responsible for the final decision; rather, the matter falls within the jurisdiction of a judge of the Republic. Thus, compliance with the authorization procedures conducted through the environmental and urban-planning process has significance in and of itself for protecting nature and preventing the harm to the community that could result from a lack of technical expertise in the construction or modification of land. This is the situation presented by the evident risk posed to water resources, the concern among citizens, and the principal obligations of environmental protection and of safeguarding compliance with the urban-planning laws that were violated. Regarding the alleged damages claimed by the plaintiff.
In this regard, we respectfully express our disagreement with the assessment of pecuniary damages (daños patrimoniales) declared by the plaintiff, even though we are aware that this is not the appropriate procedural stage for doing so, because the plaintiff provided no details or itemization whatsoever of the alleged damages in its complaint. Additionally, it seeks to recover the full value of a parcel or real property, even though, to date, neither this Municipality nor any public entity has sought to deny it the right to use the property; the plaintiff could well develop residential or commercial projects, provided that they do not conflict with urban-planning or environmental law. Additionally, apart from the fact that the assessment of the alleged damages is manifestly arbitrary, the plaintiff avoids proving them and openly seeks to recover items that are not directly and/or causally connected to the facts alleged in its complaint. Accordingly, we request that they be rejected and subjected to proper adversarial proceedings (debido contradictorio).” In its closing arguments, the Municipality’s representative stated that no material damage (daño material) exists and that recognizing it would be improper; it made statements regarding the findings of the expert report (peritaje) and the testimony of the other witnesses, refuting them, and rejected the alleged damage.-
The non-contractual civil liability (responsabilidad civil extracontractual) of the Public Administration falls within a strict-liability regime (régimen objetivo), whose basis encompasses both risk theory (teoría del riesgo) and the theory of equilibrium in the patrimonial equation (teoría del equilibrio en la ecuación patrimonial). Its essential purpose is to provide compensatory redress to anyone who has suffered an injury attributable to the public organization as a center of authority. This purposive criterion, in turn, produces a complete transformation of the central focus of liability itself, since it abandons the analytical examination of the party that caused the harm and the characterization of that party’s conduct, and instead adopts the position of the victim, who, having suffered an impairment of his or her legal position, is relieved of proving any subjective element concerning the public official involved (except insofar as the official’s personal liability is concerned).
In accordance with the strict-liability regime of the Administration established in the Political Constitution of the Republic (Articles 9, first paragraph, 11, 18, 33, 34, 41, 45, 49 first paragraph, 139 subsection 4), 140 subsection 8), 148, 188 and 191) and the provisions contained in Articles 190 et seq. and related provisions of the General Law on Public Administration (Ley General de la Administración Pública), the Administration shall be liable for all harm caused by its lawful, unlawful, normal, or abnormal operation, except in cases of force majeure (fuerza mayor), fault of the victim (culpa de la víctima), or act of a third party (hecho de un tercero). Lawfulness or unlawfulness refers essentially to whether the Administration’s formal conduct conforms to the legal system, whereas normality or abnormality refers primarily—but not exclusively—to material or technical conduct, represented, among other things, by the provision of services attributed to the State as a whole.
As stated by the First Chamber of the Supreme Court of Justice in Judgment No.000584-F-2005 at ten forty a.m. on August eleventh, 2005), abnormality concerns administrative conduct that, in itself, departs from good administration (as that concept is used by the General Law on Public Administration in Article 102, subsection d), which includes, among other things, effectiveness and efficiency), from proper organization, from technical and scientific rules, or from the expertise and prudent practice required in carrying out its actions. Abnormality may manifest itself through malfunctioning, delayed operation, or a complete failure to act. In all cases, it must be borne in mind that, under the liability regime contained in our legislation, a finding of liability depends upon the existence of a causal link (nexo de causalidad) between the administrative conduct and the resulting harm, which must be certain, actual, assessable, compensable, and not conjectural. Consequently, three essential requirements must be met:
Having reviewed the parties’ arguments and the evidence contained in the case file, this Chamber of Judges determines that the present action must be partially granted for the reasons explained below. It should be noted that any new argument included by the parties in their closing submissions that does not appear in the complaint or answer will not be analyzed, because doing otherwise would violate the principles of due process (debido proceso) and the other parties’ right of defense (derecho de defensa), as they would not have had an opportunity to respond.
Based on the foregoing, new documentation was submitted, and on 04 de setiembre de 2006, the Servicio Nacional de Aguas Subterráneas Riego y Avenamiento (SENARA) reconsidered its rejection and approved the project, finding that the area had medium vulnerability. This was immediately submitted to SETENA, which reviewed the documentation and requested additional documentation; accordingly, through Resolution number 251-20017-SETENA at 08:10 hours on 19 de febrero de 2007, it granted environmental approval (viabilidad ambiental) to the Inversiones Pelyo del Este, S.A. Service Station project. Likewise, through Resolution R-DGTCC-577-2007-MINAE at thirteen hours and fifty minutes on fourteen August two thousand seven, the Dirección General de Hidrocarburos of the Ministerio de Ambiente y Energía approved the plans and lot proposed for the construction and operation of the Inversiones Pelyo del Este, S.A. service station.
In noviembre de 2017, through official letter SA-230-317, the Director de Ingeniería of the Municipalidad de Vásquez de Coronado informed Engineer Alfredo Zeledón of that local government’s Saneamiento Ambiental department that, because the area was classified as highly vulnerable, Type A industrial activities were not permitted due to the high risk of contamination; consequently, the Inversiones Pelyo del Este, S.A. construction project was not authorized, and approval of the construction permit was made conditional upon compliance with the requirements of the Departamento de Saneamiento Ambiental. From that date onward, the plaintiff company and the Municipalidad de Vásquez de Coronado exchanged a series of notes and official letters, with the former demanding compliance with the determinations of SENARA and SETENA and the issuance of the construction permit. On 23 de junio de 2009, through official letter AL-2000-887-09 of 23 de junio de 2009, the Municipalidad de Vásquez de Coronado concluded that it would uphold its decision concerning the requirement that the Pelyo del Este project be waterproofed and its rejection of the project.
From that date until 2012, the plaintiff company filed a series of appeals against the refusal to approve the construction permit. On 17 de febrero de 2012, the Municipalidad de Vásquez de Coronado issued the construction permit to Inversiones Pelyo del Este, S.A. Construction of the Service Station began on 29 de marzo de 2012. On 07 de mayo de 2012, through official letter GS-250-004-12 of 07 de mayo de 2012, the Gestión de Saneamiento Ambiental of the Municipalidad de Vásquez de Coronado informed the Director de Aguas Subterráneas, Riego y Avenamiento (SENARA) that an inspection of the fuel-station construction project had detected a constant, high-volume surfacing of water at the same location where the station’s fuel tanks were to be installed, and that the water table (nivel freático) was at 2.6 metros. That same month, a group of residents near the service-station construction site asked the Contralor Ambiental of MINAET to investigate why environmental approval had been granted to the project, because they believed that a perched aquifer (acuífero colgado) existed at the site; they also filed constitutional protection petitions (recursos de amparo).
On 14 de mayo de 2012, through official letter GP-230-030-2012, the Municipalidad de Vásquez de Coronado informed the legal representative of Inversiones Pelyo del Este S.A. that, as a precautionary measure (medida precautoria), all construction work at the site would be halted. Likewise, in constitutional protection proceeding expediente number 12-009032-0007-CO before the Sala Constitucional, the construction work on the Proyecto Estación de Servicio Servicentro Coronado was ordered suspended in julio de 2012; and through vote 2013002023 of the Sala Constitucional at 14:30 hours on 16 de febrero de 2013, in expediente number 12-007866-0007-CO, the constitutional protection petition was granted and a group of officials was ordered to “(...) immediately take the corresponding actions, within their respective areas of authority, to ensure that construction work on the service station of Inversiones Pelyo del Este, S.A. does not continue and that its actual operation is not permitted until the measures necessary to rule out the risk of contamination of aquifers or groundwater have been adopted (...)”.
From that time onward, an environmental restoration plan (plan de recuperación ambiental) was required for the service-station construction site, and SENARA and SETENA were required to verify that the plan effectively remedied the environmental damage. This process extended from mayo de 2012 to noviembre de 2013, when, through official letter GG-OF-987-2013 of 26 de noviembre de 2013, the General Manager of SENARA informed the Secretary General of SETENA that the pit at the Estación de Servicio Pelyo del Este would be closed on miércoles 27 de noviembre de 2013; the closure was carried out and official records were prepared. On 04 and 06 de diciembre de 2013, permeability tests (pruebas de permeabilidad) were conducted by the geologist retained by the plaintiff company in the presence of personnel from the Unidad de Investigación of SENARA. On 16 de diciembre de 2013, the legal representative of Inversiones Pelyo del Este S.A. submitted the report on the closure of the pit at the Estación de Servicio Servicentro Coronado to SETENA, SENARA, and the Municipalidad de Vásquez de Coronado.
Through official letter SG-ASA-0075-2014 of 22 de enero de 2014, SETENA asked SENARA whether installing fuel tanks above ground rather than underground would be appropriate as an alternative means of obtaining hydrogeological approval (viabilidad hidrogeológica); and through official letter DIGH-UI-030-14 of 10 de febrero de 2014, the Head of the Unidad de Investigación of SENARA informed the Director of the Dirección de Investigación y Gestión Hídrica that four items remained incomplete in the plaintiff company’s new hydrogeological-approval proposal. This was communicated to SETENA, which in turn notified the company’s legal representative for the appropriate action. Subsequently, in julio de 2014, SENARA informed the legal representative of Inversiones Pelyo del Este S.A. that, after reviewing the vulnerability, it remained high and therefore continuation of the project was not recommended.
It was not until 19 de setiembre del 2014 that, through official letter IGH-0365-14, SENARA informed SETENA that the hydrogeological-approval requirements had been met, as above-ground fuel tanks had been specified for the Inversiones Pelyo del Este, S.A. project. Through Resolution number 2472-2014-SETENA at 10:00 hours on 27 de noviembre de 2014, the suspension was lifted, the project modification was approved, compliance with the regulations governing the installation of above-ground tanks was ordered, and a new bond (garantía) was authorized. That resolution was subsequently corrected through Resolution number 0541-2015-SETENA at 14:34 hours on 03 de marzo de 2015 due to a series of errors. On 05 de diciembre de 2014, the Special Attorney-in-Fact (Apoderado Especial) of Inversiones Pelyo del Este, S.A. asked the Municipalidad de Vásquez de Coronado to lift the interim measure (medida cautelar) suspending construction work.
On 09 de enero de 2015, the Municipalidad replied to the legal representative of Inversiones Pelyo del Este S.A. that it was awaiting a response from its legal adviser before issuing the appropriate reply. On 26 de enero de 2015, through Agreement number 2015-253-36 adopted at ordinary session 253 held on that same date, the Concejo Municipal de Vásquez de Coronado declared the issuance of Zoning Certificate (Certificado de Zona) 553-11 of 10 de junio de 2011, issued by Architect Dennis Jiménez Calderón of the Departamento de Planificación Urbana y Control Constructivo of the Municipalidad de Vásquez de Coronado, injurious to the public interest (lesivo). Through official letter AL-200-603-15 of 03 de junio del 2015, the Mayor of the Municipalidad de Vásquez de Coronado informed the Special Attorney-in-Fact of the plaintiff company that the official position of the Municipalidad de Vásquez de Coronado was to maintain the interim measure and institute a public-interest annulment proceeding (proceso de lesividad) against the issuance of Zoning Certificate 553-11 of 10 de junio de 2011.
The legal representative of the plaintiff company filed motions for reconsideration (recursos de revocatoria) and an appeal (apelación) against that decision, both of which were denied. The public-interest annulment proceeding was granted, and through Judgment number 20-2018-II at ten hours and thirty minutes on twenty-three March 2018, the Sección Segunda del Tribunal Contencioso Administrativo y Civil de Hacienda declared the absolute nullity (nulidad absoluta) of zoning certificate CZDIM-785-05 of 6 de octubre de 2005 issued by the Departamento de Ingeniería Municipal and of its subsequent renewals, which had formed the basis for the construction permit granted to Inversiones Pelyo del Este, S.A. This summary of actions makes clear that SETENA and/or SENARA committed no actionable act or omission and that it is therefore improper to hold them jointly and severally liable (responsables solidarios) for the damages caused to the plaintiff company, given the absence of a causal link (nexo causal) between the only two actions that the plaintiff identified as having caused those damages.
The situation is different with respect to the actions of the Municipalidad de Vásquez de Coronado; we reiterate here what has already been stated concerning the fact that the defenses asserted in its answer do not succeed in relieving it of the liability sought, which is deemed warranted. If, following the grant of a right to build based on a conforming land use (uso de suelo), the company incurred a series of expenses, that local government cannot disregard the fact that the permit gave the plaintiff company a right to build that was subsequently annulled; accordingly, the company must be compensated for any expense that it can prove, as analyzed below.- 3) Damages sought by the Plaintiff Company. Exclusion of the private reports issued by Luis Chavarría Murillo and Adolfo Lobo Zamora. Judicial expert appraisal (peritaje judicial) deemed improper. Material damages (daño material) are awarded in the abstract with respect to the construction progress completed, and the remaining relief sought is denied.
The requested non-pecuniary damages (daño moral) are denied. The plaintiff states that the Public Administration is required to compensate for any injury suffered by private parties to their property and rights, even when it results from the normal operation of public services, provided that the harm suffered by the administered party is individualized and specific and, at the same time, exceeds what may be regarded as the ordinary burdens of social life, such as so-called urban-planning burdens (cargas urbanísticas). Likewise, only actual and effective damage is compensable, rather than damage based on contingent, hypothetical, or speculative scenarios. It asserts that the harm it suffered is clearly identifiable, quantifiable, and certain, rather than hypothetical or potential, because the damage has occurred, construction work has been suspended, and the project’s future completion and commencement of operations are now radically uncertain due to the abusive and unlawful maintenance of the interim measure and the outcome of the public-interest annulment proceeding instituted by the co-defendant Municipality under judicial expediente number 15-10009-1027-CA.
It states that the project was thwarted and the investment lost, thereby causing the objective, identifiable, certain, and quantifiable damage that must be compensated, because the property was acquired solely for the construction and operation of a service station. Tribunal’s assessment: To prove the material damages that the plaintiff claims to have suffered through the expenses incurred in purchasing the land and the value of the buildings, totaling ¢ 804.151.715, it submitted with its complaint private reports prepared by Luis Chavarría Murillo and Adolfo Lobo Zamora. We shall analyze those reports together with their testimony at trial.
Images 178 to 196 of the digital judicial case file contain a report by architect Luis Chavarría Murillo, in which an appraisal (avalúo) was conducted in octubre de 2017 of the real property owned by Inversiones Pelyo de Este, S.A., property number 569222-000 in the province of San José. The legal considerations in that report state that the document is based on the documents and information provided by the owner, which he assumed to be reliable and verified generally. It also states that some of the specifications were presumed based on his experience with construction methods, without verifying them. On that basis, he determines an amount of ¢738.543.698 million colones for the land and ¢65.608.015 million colones for the unfinished shell building (edificio en obra gris). To determine the market value, he compared the land with what he calls homogeneous zones (zonas homogéneas) in other areas that are not part of Coronado and determined the value of the land; in the general description of the surrounding area, he states that the land has an excellent location, situated on the main road leading into downtown Coronado, an area of considerable commercial importance with all the services necessary for housing and commerce.
Regarding the description of the building, he mentions that it was created to support a fuel station, that only the masonry structure and roof have been built, and that he estimates the work to be approximately 35% complete. The architect states that the desirability of the land is high because of its location. In his testimony, he clarifies the points addressed in his appraisal and the methodology used. Nevertheless, that appraisal is not considered to establish a value that may be used to determine the damage. This Panel of Judges considers that it is not appropriate to recognize the value of the land requested by the party; the defendants have opposed it and presented separate arguments that are considered valid. It has not been demonstrated that the investment the party claims to have made in the parcels it combined to form property 1-569222-000 was always made with the intention of constructing a service station; the only evidence of this consists of the party’s statements in the complaint.
Moreover, that investment was made at the party’s own risk, particularly because, as stated in the proven facts, the land-use authorization (uso de suelo) that served as the basis for the plaintiff’s right to build was granted after the parcels had been combined, not before; thus, the property was assembled without knowing whether the Municipality would permit that use. Accordingly, the value of the land cannot be deemed compensable merely because it was acquired. Furthermore, the market value was calculated using locations far removed from the land at issue, which diminishes its credibility. A similar conclusion must be reached regarding the report by engineer Adolfo Lobo Zamora, insofar as it is not considered to demonstrate a compensable amount. The report states that it quantifies the economic damage resulting from the loss in value of the property and the losses (perjuicios) associated with the investment in the service station, caused by the precautionary measure (medida cautelar) suspending construction as of julio de 2012 and through setiembre de 2017.
That engineer assumes that, beginning in 2013, had the already-known events not occurred, the company would have held a permit to operate the station for five years. The report concludes that, from an economic standpoint, the property right was reduced to zero as a result of the suspension of construction when the structures were already at an advanced stage. On that basis, he takes the value of the land, treats it as an investment, carries it forward to the year 2017, and determines that the sum of ¢642.517.219 corresponds to the value of the investment before work began and to what could have been earned had it been invested in six-month certificates issued by Banco Nacional. He also calculates interest on that sum in the amount of ¢210.679.142 colones. Regarding that report, it must be noted that it contains an initial error because it is based on a future and uncertain event—namely, a permit to operate the station for five years—since nothing ensured that construction would be completed or that the operating permit (permiso de funcionamiento) would be obtained, making it non-compensable.
Second, the report is based on the premise that the suspension—which was entirely justified and lawful because it was imposed to protect the environment—was unlawful, which is not true. The suspension was therefore within the bounds of the law and was not compensable because the victim was at fault (culpa de la víctima) as the party responsible for the environmental damage. It also uses as its basis the already-discarded appraisal of the land’s market value. Along the same lines, it mentions the construction of pits for tanks, which are considered non-compensable because they caused environmental damage. It is also worth noting that the report includes what its author considers both legal and economic assessments, even though the person making them is a civil engineer and no studies in those other fields were demonstrated. On this point, the Court agrees with the defendants that there is no sunk cost (costo hundido) in the value of the land: although it can no longer be used to construct a service station, it may be used for other activities and, under those circumstances, cannot be considered immobilized or withdrawn from commerce (fuera del comercio de los hombres), as appears to be the premise of the report.
It should be noted that, in the appraisal on which the engineer relies, the architect assumes that the property is highly desirable and therefore assigns it a value far exceeding that reported by the company itself in its real-property declaration, as demonstrated by the defendant Municipality in the certification issued at nine o’clock on 23 de noviembre de 2021 by the Financial Department of the Municipalidad de Vásquez de Coronado, which states a land value of ¢276.765.489.00. Nevertheless, the engineer considers that, from an economic standpoint, its value is 0, which, for the reasons already stated, is incorrect. This Panel of Judges considers that, in these proceedings, compensation should be awarded only for costs actually demonstrated during the construction stage, not for costs predating that stage relating to the purchase of the land or the administrative procedures (tramitología) undertaken to obtain project approval, nor for projected profits from the subsequent stage, which would have consisted of obtaining a permit to operate the service station for a period of time.
That stage could not be reached because construction was not completed, but, as indicated, it was tied not to the land-use authorization or building permit (permiso de construcción), but to a separate act: the issuance of an operating permit, which was a future and uncertain event. That is the scope of what is determined to be compensable. In that same regard, the expert report (peritaje) prepared by Mr. Luis Gabelman is likewise considered incorrect. It should be noted that it is based on information provided in private reports rather than on accounting or financial information, which was the appropriate means of proving the expenditures. The expert was very clear in his report and testimony that, when he requested the accounting information, the plaintiff did not provide it and that he opted to use what he called a secondary source to determine the subject matter of the expert examination.
This secondary source was the expert report by architect Luis Chavarría, which, as stated, lacks credibility before this Court for the reasons already given. The court-appointed expert report therefore cannot be used and is excluded. As already stated, with respect to the value of the structures erected during the construction stage, this Panel considers it appropriate to recognize that value, but not the amount stated in the private reports or in the court-appointed expert report, which have already been excluded as appropriate evidence of the damage. It is particularly striking that a company organized as a legal entity would fail to maintain complete accounting records, as required by its tax obligations, and would possess only disaggregated information. The court-appointed expert stated in his report and testimony that the company did not provide him with formal accounting records. This is unacceptable with respect to the expenses of a profit-making legal entity that has a formal obligation to record its income, expenditures, assets, and net worth and to file its annual return.
On that basis, this Panel rules that the only damage recognized in favor of the plaintiff company consists of the expenses incurred during the construction period that it succeeds in actually proving—which shall not include expenses it incurred to mitigate the environmental damage it caused—during the judgment-enforcement stage (etapa de ejecución de sentencia), through an expert examination supported by accounting, financial, or documentary evidence deemed credible by the enforcement judge; the amount determined shall be adjusted to present value. The requested statutory interest (intereses legales) on that amount is denied because indexation (indexación) is deemed to cover the loss in the value of money as of the time the amount is set. With regard to the non-pecuniary damage (daño moral), which the plaintiff alleged consisted of harm to its good name and commercial image in its activities in the national free market and which it calculated at five million colones, this Panel of Judges determines that it is unwarranted because the plaintiff provided no circumstantial evidence (indicio) from which such damage could be established.
Under Article 41.1 of the Código Procesal Civil, applicable pursuant to Article 220 of the Código Procesal Contencioso Administrativo, it was incumbent upon the plaintiff to do so. That provision states: “41.1 Burden of proof. The burden of proof lies: 1. With the person asserting a claim, with respect to the facts constituting that person’s right. (...)”; the plaintiff was therefore required to provide evidence—in this case, circumstantial evidence—of the alleged damage caused, and it did not do so in this matter, making analysis of that damage impossible. It was necessary to demonstrate how the good name and commercial image of Inversiones Pelyo del Este were affected in relation to other merchants or third parties, and none of this was done; the claim must therefore be denied. In the same vein, the claim for what the plaintiff called losses, understood as the sums of money it failed to receive, equivalent to what would have been earned had the investment—based on what was actually spent—been placed in six-month debt securities issued by Banco Nacional de Costa Rica, and which it quantified at ¢ 210.679.142, is denied.
This requested item assumes that the full amount sought for property damage (daño material) is warranted, which has been rejected; in any event, when the construction expenses eligible for recognition were specified, this item was ordered denied.-
The defendants raise the defenses of lack of legal standing and lack of active and passive standing. In light of the record, the defenses of lack of active and passive standing must be denied because, as indicated in the preceding recital, the plaintiff directs its claim against a series of administrative actions by the defendants, with whom it interacted in obtaining approval for a construction project. The situation is different with respect to the defense of lack of legal entitlement, which is partially upheld, and only with respect to the Municipality of Vásquez de Coronado, ruling out liability on the part of the State and Senara, since, as indicated in the preceding recital of this decision, the plaintiff is not entitled to relief regarding the claim for compensation against them, but is entitled to relief against the local government. .-
Pursuant to section 193 of the Code of Administrative Procedure, procedural costs and attorney’s fees constitute a burden imposed on the losing party by virtue of having lost. Waiver of such an award is viable only when, in the Court’s judgment, there was sufficient cause to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, this Collegiate Body finds grounds to apply the exceptions established by the applicable regulations with respect to the Municipality of Vásquez de Coronado and the plaintiff, because there has been reciprocal defeat: although an amount was awarded for pecuniary damage, some of the claims were denied. Both parties therefore had grounds to litigate, as the Municipality was correct regarding the denial of part of the claim for compensation, and the plaintiff was correct regarding the claim relating to the expenses of the construction performed.
Accordingly, no special award of costs is made. With respect to the State and Senara, however, this Collegiate Body finds no grounds to apply the exceptions established by the applicable regulations because, as stated supra, the plaintiff has lost this action, as it has no legal entitlement against those defendants; accordingly, the plaintiff is ordered to pay both categories of costs incurred by the State and Senara in these proceedings. The plaintiff is also ordered to pay the State interest on the costs from the date this judgment becomes final until payment in full.-
POR TANTO
The evidence submitted by the Municipality of Vásquez de Coronado for the purpose of rendering a better-informed decision is admitted. The defenses of lack of active and passive standing raised by the State and Senara are denied. The defense of lack of legal entitlement raised by the State and Senara is upheld and, with respect to the Municipality of Vásquez de Coronado, is partially upheld. Consequently, the action is denied insofar as it concerns the defendants, the State and Senara. The action filed by Inversiones Pelyo del Este S.A. against the Municipality of Vásquez de Coronado is partially granted. The Municipality of Vásquez de Coronado is ordered to pay the plaintiff company’s material damages, consisting of the expenses it incurred in the construction performed before work was halted, the amount of which shall be determined during enforcement of the judgment under the terms set forth in the substantive recital of this judgment.
The plaintiff must demonstrate the expenses incurred during the construction period—excluding the expenses it incurred to mitigate the environmental damage—through an expert appraisal accompanied by accounting, financial, or documentary evidence deemed credible by the enforcement judge, and the amount determined shall be adjusted to present value; in all other respects, the action shall be understood to have been denied insofar as relief was not expressly granted. With respect to the plaintiff and the Municipality of Vásquez de Coronado, the matter is decided without a special award of costs. The plaintiff shall bear the costs with respect to the State and Senara. The plaintiff is also ordered to pay interest on the costs awarded to the plaintiff, in favor of the State, from the date this judgment becomes final until payment in full. ESTADO, SETENA Y MUNICIPALIDAD VÁSQUEZ DE CORONADO No-10-2022-I SECCIÓN PRIMERA DEL TRIBUNAL CONTENCIOSO ADMINISTRATIVO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, ANEXO A, Calle Blancos, a las once horas con cuarenta y cinco minutos del veintisiete de enero del dos mil veintidós.- Proceso de conocimiento interpuesto por la empresa Inversiones Pelyo del Este S.A., representada por sus Apoderados Especiales Judiciales, los Lic. Manrique Jiménez Meza, divorciado una vez, vecino de Barrio Escalante, portador de la cédula de identidad número 1-487-250, y Federico Peraza Bedoya, divorciado una vez, vecino de Pozos de Santa Ana, portador de la cédula de identidad número 1-1043-0088, en contra del Estado representado por la Procuradora Estatal, Licda. Ana Cecilia Chen Apuy, casada, vecina de Heredia, portadora de la cédula de identidad 1-787-209; la Municipalidad de Vásquez de Coronado, (en adelante Municipalidad), representada por su Apoderado Especial Judicial, Lic. Rolando Alberto Segura Ramírez, casado una vez, vecino de Vásquez de Coronado, portador de la cédula de identidad número 1-0625-0122, y el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, (en adelante Senara), representado por sus Apoderados Especiales Judiciales, los Lic. Enmanuel López Vargas, casado, portador de la cédula de identidad número 7-132-772 y Giovanni López Jiménez, divorciado, portador de la cédula de identidad número 1-701-815. Todos mayores y abogados.-
RESULTANDO
I.En fecha 07 de febrero de 2018, la empresa Inversiones Pelyo del Este S.A. interpone proceso de conocimiento en contra del Estado, Senara y la Municipalidad de Vásquez de Coronado, formulando las siguientes pretensiones: "1. Con lugar la presente demanda en todos sus extremos. 2. Que, por cumplirse con los requisitos para la aplicación de la responsabilidad objetiva de la Administración Pública, se condene solidariamente a las partes codemandadas, sean a SENARA, Estado y Municipalidad de Vásquez de Coronado, a los siguientes rubros fijados de manera prudencial -sin perjuicio de su adaptación durante el iter procedimental- hasta su reconocimiento en sentencia firme y definitiva, así: A. Por daño patrimonial, entendido por los gastos en que debió incurrir la parte actora por impulso causal y vinculante de las demandadas para la compra del terreno, y el valor de las edificaciones; a saber: ¢ 804.151.715 CRC (OCHOCIENTOS CUATRO MILLONES CIENTO CINCUENTA Y UN MIL SETECIENTOS QUINCE COLONES COSTARRICENSES).
B. Por perjuicios, los cuales son entendidos como las sumas dinerarias dejadas de percibir, equivalentes a lo que se hubiera obtenido en caso de haberse colocado para la obtención de créditos desde la base de lo que efectivamente se gastó, en títulos de deuda a seis meses plazo del Banco Nacional de Costa Rica, a saber: ¢ 210.679.142 CRC (DOSCIENTOS DIEZ MILLONES SEISCIENTOS SETENTA Y NUEVE MIL CIENTO CUARENTA Y DOS COLONES COSTARRICENSES). 3. Se declare la condenatoria contra la Municipalidad codemandada, bajo el criterio de la sana crítica de los señores(as) juzgadores(as), por el daño moral ocasionado al buen nombre e imagen comerciales de la actora, en su actividad en el libre mercado nacional. Esto, por haber persistido esta Municipalidad, en la continuidad de la medida cautelar suspensiva inicialmente adoptada, a pesar de la existencia de criterios técnicos y jurídicos de órganos internos de la propia municipalidad que no avalaron la indicada suspensión de efecto continuado y la orden de la Sala Constitucional que condicionó tal suspensión a lo que fue cumplido por la actora en su oportunidad.
Por este rubro se solicita la condena por la suma de ¢ 5.000.000 CRC (CINCO MILLONES DE COLONES COSTARRICENSES). 4. Se declare la condenatoria en forma solidaria contra las partes codemandadas al pago de los daños y perjuicios por las sumas supra indicadas, con la excepción del daño moral que corresponde única y exclusivamente a la Municipalidad demandada conforme lo indicado en la pretensión anterior (número 3). 5. Que, en la eventualidad que en sentencia se declare una condena en abstracto contra las partes co-demandadas, sea de manera total o parcialmente, se harán valer los derechos de nuestra representada en la etapa de ejecución de sentencia, no obstante la identificación y cuantificaciones precisas aquí señaladas y debidamente constatadas. 6. Se declare, contra las partes co-demandadas, la condenatoria solidaria del pago de los intereses legales hasta su efectiva cancelación y sin perjuicio de la indexación monetaria del caso. 7.
Se declare, contra las partes co-demandadas, al pago solidario en ambas costas, sin perjuicio de lo arriba indicado en cuanto a los daños y perjuicios.". (Ver demanda en imágenes 1 a 37 en expediente digital).-
II.Otorgado el traslado de ley, las accionadas se oponen a la acción, solicitando la Municipalidad de Vásquez de Coronado se rechace la demanda y la condena a la parte actora del pago de ambas costas. El Estado pide se rechace la demanda e interpone la falta de legitimación activa y pasiva y la falta de derecho, se condene al pago de costas e intereses a cargo de la parte actora. Y el Senara pide declarar sin lugar la demanda y se condene al pago de las costas e interpone la falta de legitimación pasiva y la falta de derecho. (Ver imágenes 230 a 234, 238 a 272 y 273 a 303 del expediente digital judicial).-
III.La audiencia preliminar fue celebrada a las 13:35 horas del 6 de diciembre de 2018, con la presencia de los representantes de todas las partes. (Ver audiencia preliminar y minuta en expediente digital judicial).-
IV.El juicio oral y público, fue celebrado el 25 de noviembre de 2021, con la participación de todas las partes. En dicha audiencia por las condiciones sanitarias vigentes, se entra directamente a recibir la prueba pericial y testimonial admitida en la audiencia preliminar, se ordena la reposición del expediente aportado por la Municipalidad de Vásquez de Coronado, siendo que una vez repuesto el mismo se da audiencia sobre dicha prueba y se otorga plazo para conclusiones. (Registro de la audiencia y autos en expediente digital judicial).-
V.Se dicta esta sentencia dentro del plazo de ley, tomando en cuenta el feriado del 29 de noviembre de 2021, el asueto del 10 de diciembre de 2021, el cierre colectivo del Poder Judicial y el plazo para reponer el expediente administrativo y rendir conclusiones otorgado, por unanimidad y previa deliberación de los integrantes del Tribunal, sin que se observen causales capaces de invalidar lo actuado.-
Redacta la Juez Miranda Alvarado, con el voto afirmativo de las juzgadoras Zúñiga Mora y Gómez Chacón.
CONSIDERANDO
En la audiencia preliminar de las trece horas con treinta y cinco minutos del día seis de diciembre del dos mil dieciocho, la Municipalidad aporta un serie de documentos de los cuales el Juez de Trámite dio plazo a las otras partes para que se refirieran a la misma y que sería este Tribunal de Juicio quien determinaría su admisión o rechazo. Asimismo, el día del juicio oral y público la Municipalidad ofreció una nota fechada 23 de noviembre de 2021 respecto del valor declarado por la sociedad actora de la finca número 569222 del Partido de San José y sobre dicho oficio se dio audiencia a las partes en ese momento. Sobre dicha probanza esta Cámara dispuso revisar la misma durante la deliberación y decidir si la admitía o rechazaba. Ahora bien, una vez revisada la prueba, se concluye que parte de la misma ya consta en los expedientes administrativos admitidos como prueba, pero hay una actualización del certificado de uso de suelo al año 2018, este documento y el presentado del día del juicio, se admiten en tanto aportan elementos de prueba para la resolución de esta litis.-
II.DE LOS HECHOS PROBADOS.- De importancia para la resolución de este asunto, se tiene como debidamente acreditado lo siguiente:

De interés es mencionar, que no se acreditaron por las partes los siguientes hechos de interés: 1) El costo de los materiales, asesoría y mano de obra del avance en la construcción realizada en la finca del Partido de San José número 569222. 2) Que la finca número 569222 del Partido de San José a raíz de la nulidad del certificado de uso de suelo quedara fuera del comercio de los hombres al perder cualquier valor. 3) Que la empresa actora estuviera autorizada para el expendio de hidrocarburos. 4) Que la finca número 569222 del Partido de San José, fuera adquirida por la parte actora con el único objetivo de establecer en ella una estación de servicio. 5) El daño moral pretendido por la sociedad actora. (los autos).-
En su escrito de demanda, la sociedad actora plantea en lo que interesa que: "(...) DERECHO I.- SOBRE LA RESPONSABILIDAD DEL ESTADO Y LAS ADMINISTRACIONES PÚBLICAS ACTIVAS. Los Tribunales europeos desde hace tiempo atrás han venido insistiendo en que el reconocimiento claro y paladino de la Administración Pública, en lo que respecta a la certeza de los daños originados, implica, a su vez, la implícita confesión de la causa generatriz del perjuicio ocasionado, ya que la exigencia, o no, de una responsabilidad de orden económico, viene establecida por una serie de normas de acatamiento obligatorio que le son de obligada vinculación en virtud, atención y cumplimiento de los rigurosos alcances del principio de legalidad. Tema que, como se verá, es de especial importancia para el presente caso, en virtud del reconocimiento expreso que realiza una de las demandadas al incoar un proceso de Iesividad según expediente judicial número 15-10009-1027-CA que se encuentra a la espera del dictado de la sentencia de fondo por parte del Tribunal Contencioso Administrativo.
Así, pues, hemos de partir teniendo presente que los preceptos que regulan la responsabilidad de la Administración activa se refieren, única y exclusivamente, al supuesto de daños y perjuicios ocasionados en el patrimonio privado de la actora, como consecuencia del funcionamiento normal o anormal, lícito o ilícito de la Administración activa. En efecto, la configuración de la responsabilidad objetiva que para la Administración activa vienen a imponer los artículos 190, siguientes y concordantes de la Ley General de la Administración Pública (LGAP), cuando disponen que responderá la respectiva Administración Pública de todos los daños que sufran los particulares en sus bienes y derechos causados por su funcionamiento legítimo o ilegitimo, normal o anormal, salvo en los casos de fuerza mayor, culpa de la victima o hecho de un tercero. La relación causal del funcionamiento normal o anormal de la Administración activa tiene también aplicación contra las municipalidades como entes descentralizados por razón del territorio cantonal.
Por consiguiente, le corresponde a la Administración activa, basado en la definición del articulo 1 ibídem, la responsabilidad de indemnizar a los particulares de los daños y perjuicios ocasionados en su patrimonio, siempre que reúnan las condiciones de ser ciertos (no hipotéticos), en relación de causalidad con las conductas administrativas, que sean económicamente evaluables y susceptibles de individualización en sus efectos materiales. Así, pues, la LGAP acoge el principio del régimen de extensión de la responsabilidad del Estado, tal como se comprueba mediante una simple lectura de su numeral 190, al disponer que la Administración responderá por todos los daños que cause su funcionamiento legitimo o ilegitimo, lícito o ilícito, normal o anormal. A pesar de ello, la transición entre la aplicación del Código Civil -vid. numeral 1045- y la LGAP aparejó años de adaptación, tanto asi que para el año 1991 aún era común encontrar pretensiones cobratorias bajo el enfoque estrictamente civilista.
En este sentido se ha manifestado la Sala Primera de la Corte Suprema de Justicia: "Por lo tanto, se ha evolucionado de un sistema en el que se obligaba a la víctima a demostrar la culpa o el dolo del agente para poder exigirle responsabilidad al Estado, a otro en el cual ya no es necesaria la identificación del agente causante del daño, sino que lo que debe demostrarse es que el daño es producto de una ilegitimidad, ilicitud, o anormalidad administrativa, o bien de actuaciones legítimas, lícitas y normales; pero en estos últimos supuestos además se deberá demostrar que la lesión es excepcional, ya sea por la pequeña proporción de los afectados o por la intensidad de ésta, casos en los cuales la reparación se reduce a los daños sin incluir los perjuicios." (Al respecto véase: SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA, n. 45 de las 14:45 horas del 25 de abril de 1995.) A lo indicado hemos de agregar que, dándose los supuestos de la responsabilidad objetiva antes señalados, el resarcimiento de los daños debe ser plenario, se decir debe abarcar tanto el daño patrimonial como el moral y sus respectivos perjuicios.
Sobre el particular ha señalado la Sala Primera de la Corte Suprema de Justicia: "(...) el resarcimiento del daño debe ser plenario, in integrum", y en manera alguna simbólico y debe incluir el daño moral... Finalmente, el artículo 191 ibídem manda a la Administración a reparar todo daño causado a los derechos subjetivos ajenos por faltas de sus servidores, con lo que se refuerza la tesis de que el daño moral debe ser indemnizado, pues "todo daño" es un concepto amplio que abarca tanto daños materiales como morales." (Al respecto véase: SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA, n. 118 de las 14:40 horas del 6 de noviembre de 1996.) En todo caso, ha sido con el desarrollo de la jurisprudencia de la SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA que se han aclarado y puntualizado conceptos de especial importancia como es el que corresponde al de la anormalidad. Al respecto se ha indicado: " (...) atiende a aquellas conductas administrativas, que en sí mismas, se apartan de la buena administración (conforme al concepto utilizado por la propia Ley General en el artículo 102 inciso d, que entre otras cosas incluye la eficacia y la eficiencia) o de la organización, de las reglas técnicas o de la pericia y el prudente quehacer en el despliegue de sus actuaciones, con efecto lesivo para la persona.
Esto permite señalar que la anormalidad puede manifestarse a través de un mal funcionamiento; un funcionamiento tardío, o una ausencia total de funcionamiento. Anormalidad e ilicitud, no deben por tanto adoptarse como conceptos equivalentes, ni siquiera en lo que corresponde a la hipótesis de aquel funcionamiento que siendo debido o conforme con las reglas antedichas, produce un resultado dañoso (denominado por algún sector doctrinal como "funcionamiento anormal por resultado), pues, en tal caso, lo que opera es una responsabilidad por funcionamiento normal con efecto o resultado lesivo, indemnizable, claro está, siempre que se cubran los requisitos preestablecidos expresamente por el propio ordenamiento jurídico (véase el mismo articulo 194 de la Ley General de la Administración Pública).". Ahora bien, nótese desde ya que dentro del concepto de anormalidad se encuentran comprendidas aquellas situaciones donde se presenta la inactividad u omisión de la Administración, dicho de otro modo, cuando existiendo un deber funcional de actuar o una necesidad de diligencia funcional, simple y llanamente no se actúa, causando con ello un daño de efecto negativo a nivel patrimonial.
Por consiguiente, cuando el articulo 190 de la Ley General de la Administración Pública determina que la Administración responde por el funcionamiento normal y anormal se incluye la responsabilidad objetiva por inactividad administrativa, siempre que exista un deber funcional de actuar o el cumplimiento de una conducta debida, tal como sucede en el caso sub examine. En este sentido, hemos de indicar que ha tenido sobrada atención la diferencia entre la omisión formal respecto a la omisión material, siendo que la primera se da en el marco del procedimiento administrativo, cuando debiendo dictarse algún acto administrativo, contrariamente no se da. Este es precisamente el supuesto aplicativo al presente caso ante la negativa en el levantamiento de la medida cautelar a pesar de haberse cumplido con todas condiciones establecidas por la SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA y las autoridades competentes.
Ahora bien y complementariamente, la omisión material se presenta ante la desatención de una obligación de dictar una actuación material o técnica, previamente establecida. Por su parte, la introducción de la omisión como forma de anormalidad es de suma importancia en la jurisprudencia, ya que lamentablemente es una situación típica y acomodaticia dentro del quehacer institucional costarricense. Así, pues, la omisión como forma de anormalidad en el funcionamiento administrativo, constituye una fuente de imputación que en tanto sea la causa generadora de una lesión, imponiéndose así el deber compensatorio. En lo que acá nos atiende la SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA se ha manifestado del siguiente modo: " (...) De ahí que, ha de afirmarse de manera contundente...que la Administración Pública también es responsable por los daños y perjuicios ocasionados con su inactividad. Esa pasividad frente al cumplimiento de obligaciones preexistentes se enmarca, para efectos de la responsabilidad patrimonial extracontractual, como funcionamiento anormal de la Administración, en tanto se corresponda con una actividad materia debida, y con una conducta ilegítima, que para este caso puede ser concurrente, en la medida en que el incumplimiento de lo debido no sólo atenta contra las reglas de buena administración, sino que infringe la jurisdicción en tanto incumple las potestades administrativas funcionales que dimanan del propio Ordenamiento Jurídico.
Esto es tanto más acentuado cuanto de servicios públicos se trata, pues el incumplimiento de una actividad u obra de titularidad pública, las más de las veces, también de interés general, potencial el nivel de riego inherente al servicio y agudiza la afectación del colectivo, con eventual lesión directa de particulares situaciones subjetivas. En este ámbito de la responsabilidad pública por inacción, puede ocurrir que la lesión provenga, por vía directa y exclusiva, de la indolencia administrativa, en tanto es suficiente para producir por sí misma un efecto negativo en la situación jurídica, preexistente o potencial, de aquel o aquella titular de un interés subjetivo pleno. Pero también suele ocurrir, y cada vez con más frecuencia, que la lesión tiene por causa un doble comportamiento, uno, ejercicio por un agente -público o privado-, por cuya acción se produce el menoscabo en la esfera jurídica vital del o los lesionados; y otro, que concurren con aquél, representado por la inacción de la autoridad pública que no ejerce, como es debido, la conducta requerida para evitar el daño".
Entre todo lo indicado salta a la vista un tema de especial importancia para el presente caso que se relaciona con la cuota de participación de los diversos actores involucrados en determinadas conductas de coparticipación activa, así como la posible vinculación de cada conducta a la cual se atribuye la lesión. En este orden de ideas, es imperativa la necesidad de abordar un examen de la denominada causa adecuada. Esto es, determinar cuál de todas las omisiones fue la que en intensidad provocó el mayor daño, o si por el contrario, se debió a la correlación de varias omisiones. Ahora bien, como se dijo, en el caso sub exámine el daño causal es el resultado de acciones y omisiones (conductas administrativas) que permiten determinar tal relación de causalidad de manera coparticipativa por el grado de corresponsabilidad negativa en el patrimonio material y moral de nuestra representada. Ciertamente, en casos similares nuestras autoridades judiciales han aplicado los artículos 9 y 10 de la LGAP y el numeral 1046 del Código Civil.
En torno a este tema la SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA indicó: "(...) las omisiones en que incurrió el Estado lo incorporan dentro de lo sujetos de derecho que conformaron un cúmulo de causas en la generación del daño causado, que por tal, supone una solidaridad en la responsabilidad que deben necesariamente asumir por el no cumplimiento de sus funciones, máxime al considerar que estas son de corte preventivo, todo ello a tenor de los dispuestos por el artículo1046 del Código Civil, aplicable supletoriamente en este campo, por disposición expresa de los preceptos 9 y 10 de la Ley General de la Administración Pública. De lo anterior se colige la responsabilidad de la Administración Central por el daño ocasionado a los actores, la cual comparte con el INS y la Municipalidad, y aun cuando medió la participación de un tercero, esta incursión no conlleva a una eximente, que en todo caso, sería una atenuante, pero no un elemento que elimine del todo la responsabilidad del Estado por que en este orden, bien resolvió el Tribunal al considerar la solidaridad del recurrente, ergo, deben rechazarse los motivos formulados." (Al respecto véase: SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA, voto número 308-F-2006 de las 10:30 horas del 25 de mayo del 2006.) También es importante rescatar y resaltar lo que la misma Sala Primera ha indicado en cuanto a que no es cualquier daño el que da base para la obligación de resarcir, pues deben confluir los siguientes elementos, para su ejecución, a saber: i) el daño debe ser cierto, real y efectivo, ii) ha de darse la lesión al interés jurídicamente relevante y merecedor de protección y iii) debe darse la relación de causalidad entre la conducta y el daño en el ámbito patrimonial.
Seguidamente se analizan cada uno de las características o requisitos del instituto del daño patrimonial y resarcible con base en los acontecimientos sucedidos en contra de nuestra representada y el soporte probatorio que respaldan los argumentos y pretensiones de la presente demanda, a saber: A.- Relación de la causalidad permanente. Es una posición compartida en el Derecho comparado que la responsabilidad patrimonial de la administración no puede ser declarada cuando el resultado lesivo no es consecuencia directa, exclusiva y necesaria de la actuación administrativa, sino, por el contrario, de la actitud o negligencia del propio perjudicado. Y es que no puede ser de otro modo ya que entonces al ser éste el presupuesto determinante del nexo causal exigible faltaría, por lo mismo, la razón única o fundamento de la obligación de responder o resarcir. Por consiguiente, la responsabilidad patrimonial objetiva de la Administración no supone que la obligación de indemnizar nazca siempre que se produzca una lesión por el funcionamiento normal o anormal de la Administración, sino que es preciso y esencial que entre la lesión y este funcionamiento exista un nexo de causalidad objetivo sin que en esta relación de causa-efecto intervenga decisivamente la conducta del perjudicado.
Por lo tanto, el éxito del caso de marras depende, en gran parte y medida, en demostrar no sólo la existencia del daño, sino que, además, que se ha ocasionado a raíz de acciones u omisiones actuar de la Administración, y si bien no ha de exigirse una prueba directa y concluyente de difícil consecución, si se ha de precisar para su apreciación, deducir, conforme a las reglas del criterio racional, un enlace preciso entre uno y otro elemento. En el caso que nos atiende, el nexo causal es claro directo e inconfundible derivado del permiso otorgado, previo al cumplimiento objetivo de todos y cada uno de los requisitos reglados -y aún más-, iniciando bajo la premisa de confianza legítima en las diversas autorizaciones, aprobaciones, licencias, permisos y estudios técnico-administrativos obtenidas para la construcción y habilitación del inmueble de INVERSIONES PELYO DEL ESTE S.A. con la única y exclusiva finalidad de construir y operar la ESTACION (sic) DE SERVICIO SERVICENTRO CORONADO.
Nótese que el daño ocasionado se deriva del desconocimiento que hace la Municipalidad de Vásquez de Coronado de los alcances y el peso del permiso de construcción, pero, peor aún, es que el nexo causal es más que obvio ya que se deriva de la confianza depositada por nuestra representada en los permisos, autorizaciones y aprobaciones otorgadas para invertir, de buena fe, en la construcción de la ESTACION(sic) DE SERVICIO SERVICENTRO CORONADO. En efecto, nótese que el surtido y variopinto conjunto de procedimientos técnico administrativos que desenlazan en el permiso de construcción, son el asidero de la confianza y supuesta seguridad jurídica de la inversiones realizada, sin que se pueda o pretenda utilizar de excusa temas ambientales que fueron debidamente superados hace tiempo atrás, como ha sido confirmado y constatado por los funcionarios de la Municipalidad demandada. Tampoco sirve de excusa la interposición de un proceso lesividad para no levantar una medida cautelar cuya condición fue cumplida y cuyo proceso principal ha terminado años atrás, mucho menos puede servir de excusa o justificación para no resarcir los daños ocasionados por la inversiones realizadas por nuestra representada.
Dicho de otro modo, sin A -permisos, autorizaciones y aprobaciones- definitivamente no se habría llegado a B -construcción del proyecto-. B.- No haya culpa de la víctima o aprovechamiento propio que rompan la causalidad en perjuicio propio. Como bien ha insistido la doctrina nacional y comparada, la relación de causalidad es el nexo objetivo o externo entre la manifestación específica de la función administrativa, por acción u omisión, y la lesión antijurídica provocada al administrado. En consecuencia, debe mediar una relación inmediata, directa y exclusiva de causa a efecto entre la conducta de la función administrativa y la lesión antijurídica causada al administrado que debe ser resarcido y que no tiene el deber ni la obligación legal o moral, de soportar el daño para producir la lesión antijurídica. Partiendo de lo dispuesto en el numeral 190, párrafo 1 de la LGAP, se establecen, de manera clara y expresa, las salvedades o causales de exclusión del nexo causal.
Para lo que acá interesa en este apartado de la demanda, nos centraremos en la culpa de la víctima, entendida como una forma de autoresponsabilidad, ya que se parte del supuesto de que el administrado indujo a la la lesión antijurídica en su esfera patrimonial o extra-patrimonial al haber incurrido en una falta subjetiva que pudo ser por dolo o de culpa, destaquemos las siguientes derivaciones: i) por negligencia, ii) imprudencia e iii) impericia. El ejemplo clásico se da cuando es la victima la que participa de una manifestación pública o colectiva que a la vez sea ilegal y violenta, concluyendo con un daño en su contra como efecto de la intervención administrativa y obligada de la Fuerza Pública. Asimismo no debe confundirse la culpa de la víctima, como causal de exoneración de responsabilidad, respecto a la concurrencia de culpas o de causas que inciden en la magnitud y el quantum de la indemnización debida, dado que, en tal caso, la compensación debe ser repartida de manera equitativa, en tanto el daño causado esté estrictamente relacionado entre si y en relación con el mismo sujeto cuyo patrimonio fue afectado por la misma concurrencia causal.
También debemos señalar dos causas adicionales del nexo causalidad: fuerza mayor y hecho de un tercero. En el primer caso (fuerza mayor) se trata de un suceso que está fuera del círculo de actuación de la Administración pública activa al no ser previsible y si fuera previsible sería inevitable. Por su parte, el hecho de un tercero se refiere a los casos donde la lesión antijuridica (sic) es imputable a otro sujeto de derecho diferente de la Administración activa, este sujeto tercero rompe o corta a la vez posibilidad de existencia del nexo causal de Administración activa con el sujeto afectado. Y ninguno de estos supuestos se presentan en el presente caso donde los daños y perjuicios reclamados se derivan del mantenimiento, abusivo e ilegal, de una medida cautelar de suspensión de obras, así como por el desconocimiento e inejecución de los permisos, autorizaciones y aprobaciones otorgadas por las administraciones co-demandadas.
Asimismo, en el caso sub exámine, nuestra representada no tuvo injerencia alguna en el otorgamiento de los permisos ni en el mantenimiento abusivo e ilegal de la medida cautelar suspensiva de obras, cuando de manera contraria ya se habían cumplido con todas las condiciones establecidas para su levantamiento, de ahí la buena fe de la actora y su confianza en la presunción de validez de los permisos otorgados, entre estos el de construcción, para proceder con la inversión, con nexo de causalidad, en la construcción y futura operación de la ESTACION (sic) DE SERVICIO SERVICENTRO CORONADO. De manera complementaria a lo indicado, existen dos eximentes del nexo causalidad, sea por fuerza mayor o hecho de un tercero. En el primer caso hemos de entender que se trata de un suceso que está fuera del control de la Administración activa al ser imprevisible o que siendo previsible es inevitable. Por su parte, el hecho de un tercero se refiere a aquellos casos donde la lesión antijurídica es imputable a otro sujeto.
Y así se recalca en una realidad, cierta y objetivamente constatable: ninguno de los supuestos eximentes para la responsabilidad patrimonial administrativa, es aplicable a la presente litis, donde los daños y perjuicios reclamados se derivan del mantenimiento, abusivo e ilegal, de una medida cautelar de suspensión de obras por parte de la Municipalidad codemandada, así como por el desconocimiento de los permisos, autorizaciones y aprobaciones otorgadas en dimensión concurrente, interrelacionada y estrechamente vinculados en perjuicio de un mismo sujeto recaído en la parte actora. C.- Afectación cierta. cuantificable e individualizada. Otro elemento constitutivo para la responsabilidad patrimonial administrativa radica -se insiste- en la existencia del daño efectivo o cierto, que a la vez sea evaluable económicamente e individualizado, en relación con una persona concreta y por derivación necesaria del funcionamiento normal o anormal de los servicios y función públicos.
Y es que no puede ser de otro modo, ya que para que la lesión antijurídica tenga el carácter de resarcible o sea susceptible de generar la la obligación de indemnizar al sujeto afectado, conforme al numeral 196 de la LGAP. En efecto, ha sido un criterio compartido que la Administración Pública, en todas sus esferas, está obligada a indemnizar cualquier lesión que los particulares sufran en sus bienes y derechos, aunque sea consecuencia del funcionamiento normal de los servicios públicos, siempre que el perjuicio sufrido por el administrado sea individualizado y concreto y a la vez exceda de lo que puedan considerarse como cargas comunes de la vida social, tales como las denominadas cargas urbanísticas. Igualmente, se entiende que es únicamente indemnizable el daño producido de forma real y efectiva, no así frente a eventuales, hipotéticos o especulativos supuestos. Por esto es acertado repetir que uno de los requisitos de la responsabilidad patrimonial administrativa y de toda pretensión de daños y perjuicios, radica en su efectividad material, cierta, real por ello cuantificable económicamente en relación con algún determinado sujeto afectado o colectivo claramente identificable.
Procedamos ahora a sintetizar las características de lo que se entiende por daño resarcible -sin demérito de la insistencia- que debe ser: 1. Efectivo o cierto: no puede ser meramente eventual, hipotético o condicionado. 2. Evaluable económicamente: ser traducible o cuantificable en numerarios. 3. individualizado: respecto a una persona o grupo de personas. Al respecto ha dispuesto la SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA: "(...) VI.- No cualquier daño da pie a la obligación de resarcir Para tal efecto, han de confluir básicamente las siguientes características para ser una "daño resarcible": A) Debe ser cierto; real y efectivo, y no meramente eventual o hipotético, no puede estar fundado en realizaciones supuestas o conjeturales. El daño no pierde esta característica si su cuantificación resulta incierta, indeterminada o de difícil apreciación o prueba; tampoco debe confundirse la certeza con la actualidad, pues es admisible la reparación del daño cierto pero futuro; asimismo, no cabe confundirse la certeza con la actualidad, pues es admisible la reparación del daño cierto pero futuro; asimismo no cabe confundir el daño futuro con el lucro cesante o perjuicio, pues el primero está referido a aquel que surge como una consecuencia necesaria derivada del hecho causal o generador del daño, es decir sus repercusiones no se proyectan al incoarse el proceso.
En lo relativo a la magnitud o monto (seriedad) del daño, ello constituye un extremo de incumbencia subjetiva única del damnificado, empero el derecho no puede ocuparse de pretensiones fundadas en daños insignificantes, derivadas de una excesiva susceptibilidad. B) Debe mediar lesión a un interés jurídicamente relevante y merecedor de amparo. Así puede haber un damnificado directo y otro indirecto: el primero es la víctima del hecho dañoso, y el segundo serán los sucesores de la víctima. C) Deberá ser causado por un tercero, y subsistente, esto es, sí ha sido reparado por el responsable o un tercero (asegurador) resulta insubsistente. D) Debe mediar una relación de causalidad entre el hecho ilícito y el daño." (Al respecto véase: SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA n. 112-92 de las 14:15 horas del 15 de julio de 1992.) Para lo que acá interesa, la afectación generada es claramente individualizable, cuantificable y cierta, no hipotética ni potencial pues el daño ha sido realizado, la construcción de la obra ha sido suspendida y ahora su futura terminación y puesta en operación es radicalmente incierto, en virtud del mantenimiento abusivo e ilegal de la medida cautelar y el desenlace del proceso de Iesividad incoado por la Municipalidad co-demandada según el expediente judicial número 15-10009-1027-CA.
En todo caso, ya el proyecto fue truncado y la inversión perdida, generándose así el daño objetivo, individualizable, cierto y cuantificable que debe ser resarcido, ya que la única finalidad por la cual se adquirió el inmueble fue para la construcción y operación de una estación de servicio, según lo indicado.". En conclusiones la parte actora reitera lo ya indicado en la demanda, ratifica la responsabilidad de la Municipalidad de Vásquez de Coronado. Introduce aspectos novedosos relacionados con la responsabilidad de la Setena y Senara.
La representación del Estado al contestar esta demanda señaló en lo de interés: "(...) RAZONES Y FUNDAMENTOS JURÍDICOS (...) Las pretensiones que plantea la parte actora contra el Estado son incongruentes, inadmisibles e improcedentes. En consecuencia, deberán rechazarse con base en las siguientes razones: EXCEPCIONES: • FALTA DE LEGITIMACIÓN AD CAUSAM PASIVA, FALTA DE DERECHO Y PRESCRIPCIÓN. • Para determinar la existencia de una eventual responsabilidad patrimonial de la Administración, deben presentarse necesariamente tres presupuestos básicos sin los cuales no resulta posible su reconocimiento: I. La existencia de una acción u omisión por parte de un ente público. II. La producción de un daño que el sujeto perjudicado no tiene el deber de soportar y que tiene como características el ser efectivo, real, evaluable económicamente e individualizado. III. La existencia de una relación de causalidad entre acción u omisión administrativa y el daño infringido, es decir, que exista relación directa de causa a efecto entre el hecho que se imputa y el daño producido.
Sobre el primer supuesto -acción u omisión del Estado- en ningún momento el Estado ha realizado acción u omitido algo que genera daño o perjuicio económico alguno a la sociedad actora. En ese sentido tal y como se ha mencionado desde el inicio y como se ampliará, la propia parte reconoció abiertamente, que SETENA y el resto de las autoridades competentes, entiéndase la DGTCC, "han dejado claro su posición favorable al proyecto" (apartado de la demanda titulado "ANTECEDENTES"). Dicho de otro modo, la parte accionante -de manera expresa reconoce que las conductas llevadas a cabo por el Estado no han puesto en peligro o amenazado siquiera su proyecto. Ahora bien, en cuanto a la producción del daño, el mismo no existe y en todo caso no es responsabilidad del Estado, por cuanto las conductas que finalmente cuestiona son atribuibles únicamente a la Municipalidad de Vásquez de Coronado (hecho de un tercero) -tal y como indicaremos más adelante-.
Así, evidentemente, tampoco existe nexo causal, el cuadro fáctico que presenta la actora carece de los elementos esenciales de la responsabilidad administrativa, cual es la existencia del nexo causal o relación de causalidad, que constituye el "puente" entre la conducta administrativa y el daño producido, sea entre la Administración y el administrado. Conforme lo anotado, se reitera que el actor reconoce expresamente que la conducta administrativa de mí Representado era "Favorable al proyecto". Bajo este contexto, de acuerdo al numeral 190 de la Ley General de la Administración Pública, dichos presupuestos no encuentran asidero, fáctico ni jurídico para imputar de responsabilidad al Estado, ergo no existe responsabilidad estatal. En todo caso, sin perjuicio de lo anterior, es evidente la presencia del hecho de un tercero respecto de la citada Municipalidad, que como se detallará es el ente que tiene la potestad constitucional y legal para otorgar finalmente las licencias constructivas, suspenderlas o renovarlas.
Al efecto, en lo conducente, dispone dicho artículo: "1. La Administración responderá por todos los daños que cause su funcionamiento legitimo o ilegitimo, normal o anormal salvo fuerza mayor o culpa de la víctima o hecho de un tercero. "(El resaltado es nuestro). Así las cosas, si se presenta alguna de las causales dispuestas en el anterior numeral, se origina la ruptura del nexo de causalidad y consecuentemente se extingue la responsabilidad de la Administración. Así las cosas, la confesión espontánea de la parte actora, que reconoce que el proceder de mi Representado era "Favorable al proyecto", no así la conducta de la Municipalidad (la medida cautelar y el proceso de Iesividad), es clara muestra que existe un eximente de responsabilidad para el Estado (hecho de un tercero), en cuanto este no fue el que causó el daño hipotético que le imputa al Estado. En esa línea, la accionante expresamente señala: "Nótese que el daño ocasionado se deriva del desconocimiento que hace la Municipalidad de Vásquez de Coronado de los alcances y peso del permiso de construcción (..) tampoco sirve de escusa [sic] la interposición de un proceso de lesividad para no levantar una medida cautelar (...) mucho menos puede servir de excusa o justificación para no resarcir los daños ocasionados por la [sic] inversiones realizadas por nuestra representada (..) los daños y perjuicios reclamados se derivan del mantenimiento, abusivo e ilegal de una medida cautelar de suspensión de obras por parte de la Municipalidad codemandada, así como el desconocimiento de los permisos; autorizaciones y aprobaciones otorgadas en dimensión concurrente, interrelacionada y estrechamente vinculados (...) Para lo que acá interesa, la afectación generada es claramente individualizable, cuantificable y cierta, no hipotética ni potencial pues el daño ha sido realizado la construcción de la obra ha sido suspendida y ahora su futura terminación y puesta en operación es radicalmente incierto en virtud del mantenimiento abusivo e ilegal de la medida cautelar y el desenlace del proceso de lesividad incoado por la Municipalidad co-demandada según el expediente judicial número 15-10009-I027-CA." (sic) Por otra parte, la parte actora solicita que sobre mi Representado sea declarada la existencia de una responsabilidad objetiva, tal y como lo expone en la pretensión numerada 2, pero lo cierto del caso es que la actora no ha señalado un solo acto u omisión nuestra que le hubiere podido causar un daño o perjuicio, valga acotar no existe en todo caso.
Lo anterior se refuerza cuando en la pretensión numerada 3 solicita el pago de daño moral a la Municipalidad, manifestando expresamente que este se solicita "por haber persistido esta Municipalidad en la continuidad de la medida cautelar suspensiva inicialmente adoptada, a pesar de la existencia de criterios técnicos y jurídicos internos de la propia municipalidad que no avalaron la indicada suspensión (..)" (sic) Es decir, si comparamos ambas pretensiones, la numero 2, no tiene un fundamento de hecho, como si lo tiene la que dirige contra el gobierno local. Por ende, es claro que los actos que la parte actora entiende como supuestamente dañinos, son únicamente los de la Municipalidad. o Sobre las competencias municipales en certificados de uso de suelos y licencias constructivas: Como es bien sabido, en materia local urbanística y ambiental, las Municipalidades tienen la competencia absoluta en la emisión de licencias constructivas, por ende, también para su mantenimiento y suspensión.
Lo anterior, según lo ha dispuesto la propia Constitución Política y las demás leyes relacionadas. En esa linea, la Sala Constitucional ha apuntado: "las corporaciones municipales tienen un papel de primer orden en la protección y conservación de las aguas subterráneas a través de una serie de instrumentos indirectos. Así la Ley de Planificación Urbana (No. 4240 del 15 de noviembre de 1968), nace más de 35 años con fundamento en el ordinal 169 de la Constitución Política -en cuanto les compete la administración de los intereses y servicios locales en cada Cantón, les impuso el deber de promulgar un plan regulador para planificar y controlar el desarrollo urbano y los reglamentos de desarrollo urbano conexos (artículos 15 y siguientes). Dentro de ese plan regulador y el reglamento de zonificación, las Municipalidades deben identifican a efecto de regulan controlar y restringir las actividades humanas (industrial urbanística, agropecuaria, etc.), las áreas o zonas reservadas por ubicarse en las mismas un manto acuífero o su área de recarga o descarga.
Por aplicación de los derechos fundamentales a un ambiente sano y ecológicamente equilibrado (artículo 50 de la Constitución Política), a la vida y la salud humanas (articulo 21 ibídem) y en aras de un desarrollo sostenible los cantones que por sus características geomorfológicas cuenten en su circunscripción terrenos que alberguen mantos acuíferos áreas de recarga y descarga de éstos manantiales y nacientes están especialmente llamados y obligados a regular y normar responsable, eficiente y eficazmente, tales extremos puesto que, en ocasiones las aguas subterráneas no solo proveen al consumo y uso de las poblaciones del cantón sino a diversos cantones lo que demuestra un claro interés supra local o nacional. Los habitantes de esas localidades de su parte, deben soportar la carga general o las limitaciones y restricciones en el uso y el aprovechamiento del suelo y de las aguas derivadas de la determinación y fijación de tales áreas protegidas, puesto que, es en beneficio de ellos, de los habitantes de los otros cantones que son abastecidos con las aguas que discurren por el manto acuífero y que afloran o descargan en otros cantones n desde luego, de las futuras generaciones." (Voto N° 2004-01923 de las 14 horas con 55 minutos del 25 de febrero del 2004).
También, esta Procuraduría General de la República ha emitido dictámenes en los que deja clara la competencia del gobierno local: "las funciones urbanísticas comprenden la elaboración y aprobación del plan regulador y regulaciones complementarias, como el Reglamento de Zonificación, Reglamento de Fraccionamiento y Urbanizaciones, Mapa Oficial y Reglamento de Renovación Urbana; el otorgamiento de permisos de fraccionamiento, urbanización, construcción; así como el ámbito sancionatorio (Ley de Planificación Urbana, artículos 15, 16 21, 24, 32; Ley de Construcciones, artículos 151 87-89 y 96). "(Dictamen C-001-2013 del 9 de enero del 2013). Ahora bien, en el marco de estas competencias, la Municipalidad codemandada, por acuerdo N° 2015-253-36 adoptado en la sesión ordinaria N°253 del 23 de febrero de 2015, acordó declarar lesivos los certificados de uso de suelo relacionados con este asunto y presentó ante el Tribunal Contencioso Administrativo, Sección Segunda, proceso contencioso de Iesividad N° 15-010009-1027-CA, contra la parte actora de este proceso, siendo que por sentencia N° 20-2018-11 de las 10 horas y 30 minutos del 23 de marzo del 2018, se resolvió: "POR TANTO Se rechaza la excepción de falta de derecho.
Se declara con lugar la demanda interpuesta. En consecuencia, se declara la nulidad absoluta de los siguientes actos administrativos: a) Certificado de Zona N° CZDIM-785-05 de fecha 6 de octubre del 2005 del Departamento de Ingeniería Municipal. b) Certificado de Zona N° 884-07 de fecha 11 de setiembre del 2007 del Departamento de Ingeniería Municipal c) Certificado de Zona No 553-11, de fecha 10 de junio del 2011 del Departamento de Planificación Urbana y Control Urbanístico. d) Certificado de Zona N° 554-11 de fecha 10 de junio del 2011. e) Permiso de Construcción N° 039.2012 de fecha 15 de marzo del 2012 del Departamento de Ingeniería Municipal o Certificado de Zona N° 552-12, de fecha 15 de marzo del 2012 del Departamento de Planificación Urbana y Control Constructivo. Son ambas costas de esta acción a cargo de la demandada." (sic) Para arribar a esta conclusión el Tribunal Contencioso determinó que los referidos certificados de uso de suelo presentaban un vicio en su motivo, toda vez que fueron emitidos contra lo dispuesto el plan regulador.
Al efecto, indicó: "V- Ahora bien, por el fondo de la cuestión sometida a debate, considera el Tribunal que, tal y como lo aduce la Municipalidad actora, los certificados de uso de suelo impugnados en esta sede ciertamente presentan un vicio en su elemento motivo, concretamente, en el fundamento jurídico aplicado para la actividad solicitada por la empresa demandada. Véase que el Plan Regulador del cantón de Vásquez de Coronado, en su artículo 21, es absolutamente claro en disponer que la actividad de Gasolinera es un uso permitido estrictamente para la Zona Lineal de Comercios y Servicios de San Antonio, cuya ubicación comprende a lo largo de la ruta 102, cruce de la Trinidad-San Antonio a San Isidro de Coronado. La norma se basta a si mismo a si misma en su literalidad y para ninguna otra zona del referido Plan Regulador se incluye la actividad de Gasolinera como un uso permitido. En consecuencia, no cabía por ningún motivo admitir como conforme el uso de suelo para la actividad de Gasolinera en un inmueble que estaba ubicado en una zona en donde ese uso no era permitido.
Al respecto, es incontrovertido que la finca de la provincia de San José matricula 569222-000 de acuerdo con su plano catastrado N°SJ-1021582-2005 se encuentra ubicada en la Zona descrita por el Plan Regulador como Zona Lineal de Residencia, Servicios y Comercio de Baja Intensidad regulada en el artículo 20 del mencionado reglamento, norma de acuerdo con la cual los usos permitidos en ese sector son: servicios públicos servicios particulares residencia unifamiliar; multifamiliar; resturantes [sic], pequeña industria artesanal comercio general edificios de estacionamiento de automóviles parqueos, hoteles, facilidades comunales y supermercados. Nótese que el uso para la actividad de gasolinera no está incluido dentro de los usos expresamente previstos para dicha zonificación, y por ende automaticamente [sic] se equipara a un uso no permitido, tal y como lo establece el artículo 3.2.1 del Plan Regulador que cuando al respecto dispone "todo uso que no este incluido en la fiesta de usos permitidos y condicionales se entiende que no están permitidos en esa zona "Es preciso apuntar que tampoco cabía hacer una labor de interpretación para incluir a las gasolineras dentro del concepto indeterminado de "comercio general", porque la primera estaba expresamente reservada para otro espacio físico ya definido específicamente para ese propósito.
Por consiguiente, el funcionario municipal competente que otorgó los usos de suelo conforme en el caso concreto, incurrió en una indebida aplicación de la norma jurídica procedente, lo que se traduce en nuestro ordenamiento jurídico administrativo en un vicio grave que afecta el motivo lo por derivación, el contenido de los actos impugnados en consecuencia, genera su nulidad absoluta, de conformidad con los artículos 132, 133, 158, 166 y 172 de la Ley General de la Administración Pública, y así se declara en este proceso de lesividad" (sic) Lo resuelto por el Tribunal es transcendente porque el accionar de la actora va dirigido a querer endilgar a mí Representado una responsabilidad que no le corresponde, cuando evidentemente lo cuestionado es competencia municipal, máxime cuando en materia urbanística-ambiental la Municipalidad es la que tiene las competencias definitivas para autorizar o no un proyecto constructivo, y que el SETENA y la DGTCC únicamente contribuyen en un procedimiento previo pero donde la última palabra la tiene el ente municipal.
Así, la Municipalidad de Vásquez de Coronado, en el ejercicio de sus competencias -en un primer momento- otorgó los certificados de uso de suelo, que autorizaron la licencia constructiva del actor y luego determinó que los mismos, eran nulos, y así lo declaró el Tribunal Contencioso. Todo lo anterior, confirmando que este ente local es el encargado de conceder o no el derecho subjetivo al actor sobre las construcciones, y no mi Representado. Conforme lo anotado, no está de más señalar, respecto de la viabilidad ambiental de SETENA, que en su individualidad el otorgamiento no permite el ejercicio de la actividad, obra o proyecto, sino que es un requisito para acceder al dictado del acto definitivo, que es aquel que permite desarrollar la obra. Así, el trámite de la viabilidad o licencia ambiental forma parte de un proceso principal autorizatorio. En ese sentido, la Sala Constitucional ha señalado: "Debe hacerse además la advertencia que la realización y aprobación del estudio de impacto ambiental no implica, en sí misma, la puesta en funcionamiento del proyecto en cuestión, por cuanto, es tan sólo uno de los requisitos exigidos para culminar el proceso de autorización que, en algunos casos, será la obtención del permiso de salud la aprobación de los planos de la urbanización por la municipalidad respectiva, el visto bueno de la concesión por la entidad competente, el otorgamiento de las licencias comerciales etc. Esto es así debido a que, tratándose del ambiente, no se puede hablar de variables inmodificables; todo lo contrario, por su propia naturaleza, el ambiente es por si mismo, la con mayor grado por intervención del ser humano, cambiante.
La aprobación de un estudio de impacto ambiental en los términos que lo señala la Ley Orgánica del Ambiente, tampoco supone una autorización inmodificable para realizar un determinado proyecto humano, toda vez que, a través de la labor de fiscalización a cargo de la Administración, al detectarse un daño al ambiente según lo establece la Convención de Río, el permiso puede revocarse, a fin de garantizar el derecho establecido en el numeral 50 de la Constitución Política y a la vez ejecutar la garantía ambiental que se dispone para resguardar la aplicación de medidas ambientales de corrección, mitigación o compensación por daños ambientales o impactos ambientales negativos no controlados por la actividad obras o proyectos. "(Voto N° 2019-2009 de las 14 horas y 55 minutos del 11 de febrero del 2009, considerando VI). (La negrita no pertenece al original). La resolución N° (sic) SETENA no era más que una "licencia de carácter ambiental para solicitar los restantes permisos ante las autoridades competentes.
" (Sala Constitucional, voto N° 17237-2010, considerando VIII). Por otro lado, respecto de la DGTCC en informe N° DGTCC-DL-84-2018 de 20 de marzo de 2018 (que se adjunta), se apuntó que este órgano informó a SETENA y a la Municipalidad de Vásquez de Coronado que debían considerar para lo que correspondiese desde el ejercicio de sus competencias, y que de parte de la DGFCC no existía, ningún acto de trámite pendiente de realizar por parte del desarrollador sobre el cumplimiento técnico del proyecto aprobado, el cual desde el punto de vista ingenieril cumplía todas las especificaciones técnicas del Decreto Ejecutivo número 30131-MINAE Reglamento para la Regulación del Sistema de Almacenamiento y Comercialización de Hidrocarburos. Lo anterior, cumpliendo mi Representado con lo ordenado por la sentencia constitucional N° 2013-2023 de las 14 horas y 30 minutos del 13 de febrero del 2013 (artículo 13 de la Ley de la Jurisdicción Constitucional), que ordenó dentro de su parte dispositiva: "(...) realizar las acciones correspondientes, de forma inmediata, dentro de sus respectivos ámbitos de competencia, para garantizar que no se continúen las obras de construcción de la estación de servicio, de [...] SA., ni se permita su efectivo funcionamiento, hasta que se hayan adoptado las medidas necesarias para descartar el riesgo de contaminación a los mantos acuíferos o aguas subterráneas (...)." (sic) Es decir, ni SETENA, ni la citada DGFCC, realizaron conductas que pudieran acarrear el supuesto daño que ahora se achaca.
No se omite indicar, que en todo caso lo actuado por mí Representado (no impugnado en este proceso y en todo caso no puede serlo evidentemente), que -se reitera- no tiene vínculo con el supuesto daño, fue realizado hace más de cinco años (artículo 198 de la Ley General de la Administración Pública). > IMPROCEDENCIA DE LOS DAÑOS RECLAMADOS. Conforme lo expuesto y en apoyo de los numerales 190 y siguientes de la LGAP, rechazamos la pretensión de la parte actora que intenta endilgarnos el pago de daño patrimonial y perjuicios. Sin perjuicio de lo anterior, se agrega lo siguiente: Sobre el daño patrimonial solicitado: La demandante solicita que en sentencia se le otorgue la exorbitante suma de ochocientos cuatro millones ciento cincuenta y un mil setecientos quince colones (¢804.751.715,00), lo anterior con fundamento en un informe privado que aporta con su demanda. En primer lugar, dicho informe no es más que un documento de índole privado realizado por el Ing. Adolfo Lobo Zamora, a solicitud expresa de la demandante para aportarlo como prueba dentro de este proceso (véase que va dirigido a ésta), por tanto se rechaza.
Sin perjuicio de lo anterior, ningún daño patrimonial es causado por el Estado (artículo 317 del Código Procesal Civil). Por otro lado, resulta completamente indebido que la parte accionante pretende que el Estado sea condenado a realizar el pago por el valor total del inmueble (absolutamente improcedente) pretendiendo a su vez mantenerse en posesión y titularidad del mismo. Adicionalmente, observe el Tribunal que la actora lo que ha referido en este asunto es la construcción de una estación de gasolina, y que a la luz de la normativa municipal se emitió una medida cautelar que suspendió los permisos para ese uso en particular. Lo anterior se desprende con total claridad de la mencionada sentencia N° 20-2018-11 de las 10 horas y 30 minutos del 23 de marzo del 2018, dentro del proceso contencioso de lesividad N° 15-010009-1027-CA: "V. (..) Nótese que el uso para la actividad de gasolinera no está incluido dentro de los usos expresamente previstos para dicha zonificación, y por ende automaticamente [sic] se equipara a un uso no permitido, tal y como lo establece el artículo 3.2.1 del Plan Regulador que cuando al respecto dispone: 'Todo uso que no este incluido en la lista de usos permitidos y condicionales se entiende que no están permitidos en esa zona" (...)" (sic) El Estado no le está cercenando su derecho de propiedad privada (artículo 45 de la Constitución Política) y menos cuando ni la medida cautelar fue impuesta por éste sino por la Municipalidad aquí demandada.
Así las cosas, el reclamo indemnizatorio es abiertamente improcedente por cuanto el Estado no es responsable, por la supuesta limitación a su derecho de propiedad, en virtud de que el control y ordenamiento territorial es una competencia Municipal. En razón de lo expuesto, la condena por ochocientos cuatro millones ciento cincuenta y un mil setecientos quince colones (¢804.751.715,00), solicitada contra el Estado debe ser rechazada. • Sobre el perjuicio solicitado: La parte actora solicita también que en sentencia se condene al Estado al pago de perjuicios por doscientos diez millones seiscientos setenta y nueve ciento cuarenta y dos colones (¢210.679.142,00), entendidos como las sumas dejadas de percibir, equivalentes a lo que se hubiera obtenido en caso de haberse colocado para la obtención de réditos desde la base de lo que efectivamente se gastó, en títulos de deuda a seis meses plazo del Banco Nacional de Costa Rica, lo anterior también, según el informe privado realizado por el Ing. Adolfo Lobo Zamora.
En primer lugar, se reitera lo indicado en el apartado anterior, en el tanto se trata de un estudio privado pagado por el propio actor para presentarlo con la demanda. Luego, el actor fundamenta dicho monto en un cálculo de intereses dejados de percibir según las tasas de interés de los certificados a seis meses plazo del Banco Nacional de Costa Rica, lo cual desde ya se rechaza. Nótese que el informe en el que funda el cálculo parte de hipótesis y suposiciones; por ejemplo, señala que los perjuicios surgen a partir de un costo hundido del terreno, e indica que debe evaluarse cual podría haber sido su uso alternativo y potencial rentabilidad, y apunta que la opción más prudente sería la de colocar el dinero invertido en títulos valores de un banco. Así, lo que en el fondo pretende el actor es que asumamos el pago de una supuesta inversión, que ellos hubieran realizado, lo que se rechaza (artículo 196 de la Ley General de la Administración Pública).
En todo caso, esta Representación se opone a la pretensión de intereses solicitados, y se reitera que el daño es inexistente y debe ser rechazado cualquier reconocimiento al respecto en contra del Estado. En este sentido los perjuicios patrimoniales de doscientos diez millones seiscientos setenta y nueve ciento cuarenta y dos colones (¢210.679.142,00) deben correr la misma suerte y ordenarse su rechazo absoluto. • Sobre los intereses legales e indexación solicitada: Esta Representación se opone a la pretensión de intereses legales y indexación solicitada, y se reitera que el daño y perjuicio es inexistente y debe ser rechazado cualquier reconocimiento al respecto en contra del Estado. • Sobre las costas: En virtud de que la demanda es absolutamente improcedente contra el Estado el condenado en costas debe ser la parte actora como expresamente se solicitará más adelante.". En conclusiones reitera lo ya indicado, se refiere al expediente de la Municipalidad de Vásquez de Coronado a los peritajes privados y su improcedencia y a la falta de nexo causal.- El representante de SENARA por su parte mencionó en resumen que, ellos se limitaron a otorgar los criterios técnicos correspondientes sobre la situación hidrogeológica del sitio.
Que SENARA no es quien da los permisos de construcción ni quien aprueba la viabilidad ambiental de los proyectos. Lo que SENARA emite en oficio ASUB-363-O6 es la evaluación de la parte hidrogeológica del sitio. a fin de que el desarrollador del proyecto tome las previsiones de diseño del proyecto y tecnología apropiada para que su proyecto no ponga el peligro ni afecte los mantos acuíferos y para que tome las medidas para evitar que su proyecto no afecte los intereses públicos. Menciona que la sentencia estimatoria de la Sala Constitucional señaló que la sociedad actora no cumplió con tomar las previsiones correspondientes para la protección del recurso hídrico (que había sido evaluada por el SENARA mediante oficio ASUB-363-06 del 4 de setiembre del 2006, realizando excavaciones más allá de las que debía al punto de llegar propiamente al acuífero, quedando este expuesto, y por tanto la Sala Constitucional ordenó al desarrollador del proyecto el cierre de la fosa que estaba generando el daño ambiental.
En conclusiones la representación del Senara reclama que no se logró demostrar la responsabilidad del Senara, hace un deslinde de responsabilidades, realiza una relación de hechos probados y no probados - Por su parte la Municipalidad de Vásquez de Coronado indicó en su contestación: "(...) CONSIDERACIONES DE DERECHO. Sobre la protección al ambiente como eje transversal del derecho público costarricense. El ordenamiento jurídico administrativo en nuestro país, ha establecido como un eje primordial en la gestión de la conducta administrativa, a los denominados principios preventivo y precautorio, sobre los que hay un sinnúmero de manifestaciones de los órganos de consulta técnica. " ...al principio preventivo, trascendental en esta materia, y que no debe confundirse con el precautorio, mediante el cual se establece una especie de presunción en favor del ambiente, de modo que, cuando no exista certeza científica sobre los efectos negativos que una actuación pueda generan se prohíba su realización, se le impongan limitaciones o se adopten medidas protectoras.
Ambos están enunciados en el artículo 11 de la Ley de Biodiversidad: "Son criterios para aplicar esta ley: 1.- Criterio preventivo: Se reconoce que es de vital importancia anticipan prevenir y atacar las causas de la pérdida de la biodiversidad o sus amenazas. 2.- Criterios precautorio o indubio pro natura: Cuando exista peligro o amenaza de daños graves o inminentes a los elementos de la biodiversidad y al conocimiento asociado con estos, la ausencia de certeza científica no deberá utilizarse como razón para postergar la adopción de medidas eficaces de protección.(...)" Y se relacionan estrechamente: "Se dice que cabe aplicar el Principio de Prevención en aquellos casos en que existe posibilidad científica de medir los riesgos y recomendar por ello, medidas para su manejo. Cuando los conocimientos científicos no llegan a ese nivel, lo procedente será, entonces, acudir al Principio Precautorio.(...)." El principio preventivo tiene relación con el carácter que deben revestir en general, las acciones para la protección del ambiente: "(...) La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos.
Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar o contener la posible afectación del ambiente o la salud de las personas. " (Sala Constitucional, Voto No. 1250 de las 1 1:24 horas del 19 de febrero de 1999, reiterado en los Votos números 2219 de las 15:18 horas del 24 de marzo de 1999, 9773 de las 9:44 horas del 3 de noviembre del 2000, 1711 de las 16:32 horas del 27 de febrero del 2001, 6322 de las 14.14 horas del 3 de julio del 2003 y 1923 de las 14:55 horas del 25 de febrero del 2004)". (Ver en este sentido la Opinión Jurídica nro. OJ-01 1-2006, del 30 de enero del 2006, de la Procuraduría General de la República). Fundamento legal de tales institutos, encontrado en la Ley de Biodiversidad, nro. 7788, del 30 de abril de 1998, en tanto dispuso: "ARTÍCULO 1.- Objeto. El objeto de la presente ley es conservar la biodiversidad y el uso sostenible de los recursos, así como distribuir en forma justa los beneficios y costos derivados.
(...) ARTICULO 5.- Marco de interpretación. Este ordenamiento jurídico servirá de marco para la interpretación del resto de las normas que regulan la materia objeto de esta ley. (...) ARTÍCULO 11.- Criterios para aplicar esta ley Son criterios para aplicar esta ley: 1.- Criterio preventivo: Se reconoce que es de vital importancia anticipan prevenir y atacar las causas de la pérdida de la biodiversidad o sus amenazas. 2.- Criterio precautorio o indubio pro natura: Cuando exista peligro o amenaza de daños graves o inminentes a los elementos de la biodiversidad y al conocimiento asociado con estos, la ausencia de certeza científica no deberá utilizarse como razón para postergar la adopción de medidas eficaces de protección. 3.- Criterio de interés público ambiental: El uso de los elementos de la biodiversidad deberá garantizar las opciones de desarrollo de las futuras generaciones, la seguridad alimentaria, la conservación de los ecosistemas, la protección de la salud humana y el mejoramiento de la calidad de vida de los ciudadanos. 4.
Criterio de integración: La conservación y el uso sostenible de la biodiversidad deberán incorporarse a los planes, los programas, las actividades y estrategias sectoriales e intersectoriales, para los efectos de que se integren al proceso de desarrollo. (...) ARTÍCULO 45.- Responsabilidad en materia de seguridad ambiental. El Estado tiene la obligación de evitar cualquier riesgo o peligro que amenace la permanencia de los ecosistemas. También deberá prevenir mitigar o restaurar los daños ambientales que amenacen la vida o deterioren su calidad. (...)" Por su parte, la Ley Orgánica del Ambiente (Ley nro. 7554 del 4 de octubre de 1995) establece, en lo que aquí nos interesa, lo siguiente: "ARTICULO 1.- Objetivos. La presente ley procurará dotar a los costarricenses y al Estado, de los instrumentos necesarios para conseguir un ambiente sano y ecológicamente equilibrado. El Estado, mediante la aplicación de esta ley, defenderá y preservará ese derecho, en busca de un mayor bienestar para todos los habitantes de la Nación.
Se define como ambiente el sistema constituido por los diferentes elementos naturales que lo integran y sus interacciones e interrelaciones con el ser humano. ARTICULO 2.- Principios. Los principios que inspiran esta ley son los siguientes: a) El ambiente es patrimonio común de todos los habitantes de la Nación, con las excepciones que establezcan la Constitución Política, los convenios internacionales y las leyes. El Estado y los particulares deben participar en su conservación y utilización sostenibles, que son de utilidad pública e interés social. b) Todos tienen derecho a disfrutar de un ambiente sano y ecológicamente sostenible para desarrollarse, así como el deber de conservarlo, según el articulo 50 de nuestra Constitución Política. c) El Estado velará por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional.
Asimismo, está obligado a propiciar un desarrollo económico y ambientalmente sostenible, entendido como el desarrollo que satisface las necesidades humanas básicas, sin comprometer las opciones de las generaciones futuras. d) Quien contamine el ambiente o le ocasione daño será responsable, conforme lo establezcan las leyes de la República y los convenios internacionales vigentes. e) El daño al ambiente constituye un delito de carácter social, pues afecta las bases de la existencia de la sociedad; económico, porque atenta contra las materias y los recursos indispensables para las actividades productivas; cultural, en tanto pone en peligro la forma de vida de las comunidades, y ético, porque atenta contra la existencia misma de las generaciones presentes y futuras. El Estado propiciará, por medio de sus instituciones, la puesta en práctica de un sistema de información con indicadores ambientales, destinados a medir la evolución y la correlación con los indicadores económicos y sociales para el país.
ARTICULO 3.- Participación conjunta para cumplir objetivos. El Gobierno fijará un conjunto armónico e interrelacionado de objetivos, orientados a mejorar el ambiente y manejar adecuadamente los recursos naturales. A estos objetivos deberán incorporarse decisiones y acciones especificas destinadas a su cumplimiento, con el respaldo de normas, instituciones y procedimientos que permitan lograr la funcionalidad de esas políticas. ARTICULO 4.- Fines. Son fines de la presente ley: c) Promover los esfuerzos necesarios para prevenir y minimizar los daños que pueden causarse al ambiente. d) Regular la conducta humana, individual o colectiva, y la actividad pública o privada respecto del ambiente, así como las relaciones y las acciones que surjan del aprovechamiento y la conservación ambiental. e) Establecer los principios que orienten las actividades de la Administración Pública en materia ambiental, incluyendo los mecanismos de coordinación para una labor eficiente y eficaz.
(...) ARTICULO 59.- Contaminación del ambiente. Se entiende por contaminación toda alteración o modificación del ambiente que pueda perjudicar la salud humana, atentar contra los recursos naturales o afectar el ambiente en general de la Nación. La descarga y la emisión de contaminantes, se ajustará, obligatoriamente, a las regulaciones técnicas que se emitan. El Estado adoptará las medidas que sean necesarias para prevenir o corregir la contaminación ambiental. ARTICULO 60.- Prevención y control de la contaminación. Para prevenir y controlar la contaminación del ambiente, el Estado, las municipalidades y las demás instituciones públicas, darán prioridad, entre otros, al establecimiento y operación de servicios adecuados en áreas fundamentales para la salud ambiental, tales como: a) El abastecimiento de agua para consumo humano. b) La disposición sanitaria de excretas, aguas servidas y aguas pluviales. c) La recolección y el manejo de desechos. d) El control de contaminación atmosférica. e) El control de la contaminación sónica. 0 El control de sustancias químicas y radiactivas.
Estos servicios se prestarán en la forma que las leyes y los reglamentos específicos lo determinen, procurando la participación de la población y sus organizaciones. ARTICULO 61.- Contingencias ambientales. La autoridad competente dictará las medidas preventivas y correctivas necesarias cuando sucedan contingencias por contaminación ambiental y otras que no estén contempladas en esta ley". De esta manera queda más que evidenciado que, el ordenamiento jurídico nacional es de un alto contenido proteccionista en materia de resguardo de los recursos naturales de la Nación. Estableciendo la posibilidad de que, los órganos ejecutivos, y más aún los jurisdiccionales, puedan tomar posiciones de resguardo latente hacia diversos bienes jurídicos tutelables de contenido ambiental. En relación con lo anterior, el derecho a la salud, es un derecho de corte fundamental que se deriva del artículo 21 (derecho a la vida) y el artículo 50 (derecho a un ambiente sano y ecológicamente equilibrado) de nuestra Constitución Política.
La línea de conceptualización del Derecho a la Salud, en nuestra jurisprudencia y de la OMS (Organización Mundial de la Salud) ha definido este primordial Derecho de la siguiente manera: "un estado completo de bienestar físico, mental, espiritual, emocional y social, y no solamente la ausencia de afecciones o enfermedades". Como se desprende del concepto anterior, el derecho a la salud va más allá de simplemente estar libre de enfermedades que vulneren el estado físico, el concepto engloba el bienestar emocional y social, que sin lugar a duda se encuentra íntimamente relacionado con la protección que puedan realizar las instituciones públicas, a los elementos ambientales, tales como el agua y el recurso hídrico en general. Cabe recordar que, como costarricenses, nuestra salud emocional y social, se puede ver vulnerada en momentos, donde se situé en una situación de constante incertidumbre frente a los potenciales daños que pueda sufrir nuestro ecosistema vital.
Enfocándonos ahora en uno de los temas clave, un derecho del cual se extrae el derecho a la Salud y se encuentra reglado en el artículo 50 de nuestra Carta Magna, tenemos el derecho a un ambiente sano y ecológicamente equilibrado, del cual se desprende dos importantes principios que son el Principio Precautorio y el Principio Preventivo, mismos que fueron por la Sala Constitucional en la resolución que ordenó la suspensión de las obras, y que a la fecha se mantiene vigente, ya que no se nos ha notificado resolución judicial en contrario. Estas apreciaciones se entrelazan con la seguridad jurídica que debe otorgar todo ordenamiento jurídico a quienes recurren a los órganos jurisdiccionales a hacer valer sus derechos. Cosa que sucedió por medio de la sentencia nro. 2013-2023, de las 14:30 horas del 13 de febrero de 2013, de la Sala Constitucional. Donde la Sala Constitucional ordenó la suspensión de las obras, en una medida que típicamente es definida como una decisión provisional adoptada con el fin de evitar un daño grave e irreversible para el recurrente, y en este caso, para los derechos de contenido difuso que pretendía tutelar.
Cabe recordar de esta manera que, en nuestro ordenamiento jurídico, de la combinación adecuada de los artículos 11, 33, 39, 41, 49 y 153 de la Constitución Política, se extrae la existencia y contenido del derecho a la tutela judicial efectiva, derecho de contenido complejo, que se manifiesta, entre otras muchas formas, en la posibilidad de acceder a los órganos jurisdiccionales, de obtener una decisión bien fundada de Juez predeterminado por la Ley, y de ejecutar en el tiempo razonable y de forma adecuada, la resolución que se dicte. A lo anterior, se tiene que agregar como parte de ese abanico, el derecho a una tutela cautelar también efectiva. Con este derecho fundamental, sin duda alguna, se garantiza algo más que la potestad decisoria para la declaración de lo que jurídicamente es debido, pues esta protección no existe, sin la consecución real de lo concedido en sentencia, y esa consumación, no se obtiene si no se adoptan medidas, garantías o cautelas precisas que aseguren la eficacia de lo resuelto.
Precisamente como la adoptada por la propia Sala Constitucional en la resolución de previa mención. La efectividad que se atribuye a la tutela judicial, exige que se reconozca no sólo el derecho abstracto de acción, sino también, el que la resolución judicial satisfaga la pretensión del recurrente. Siendo en este caso, pretensión que se encontraba íntimamente relacionada con la protección de derechos de contenido ambiental, y de amplia legitimación difusa. Sobre el proceso para la anulación de los actos propios y el debido proceso con derecho de defensa para el interesado. Afirma maliciosamente la parte actora que realiza, ya sea tácita o expresamente esta representación, reconocimiento alguno de daños y lo perjuicios, esto con el proceso de Iesividad iniciado, siendo lo correcto afirmar que, lo realizado por esta Municipalidad fue iniciar un procedimiento reglado por el ordenamiento jurídico para la revisión de su propia actividad.
Cabe recordar que, los ordenamientos jurídicos de corte liberal democrático basan su vigencia en el consagrado principio de seguridad jurídica, que implica en primer orden que las Administraciones Públicas deben proveer un marco normativo para que el ciudadano sepa a que atenerse en sus relaciones con la Administración, siendo que así, en su sentido estricto, no precisa tener un determinado contenido, sino que basta con la existencia de un conjunto de disposiciones que fijen las consecuencias jurídicas frente a ciertos hechos o actos. El rango constitucional de la seguridad jurídica y de la coherencia en el ejercicio de las competencias otorgadas a la Administración Pública, es inminente dado la trascendencia que tales valores tienen en el orden jurídico costarricense, dado la importancia que reviste con motivo de garantizar la paz y la armonía social. Así las cosas, la seguridad jurídica, como valor fundamental del ordenamiento jurídico, enmarcado dentro de un sistema social que pretende una administración pública lógica y coherente, comprende y penetra todas las relaciones jurídicas que los diversos sujetos entablan a consecuencia del ejercicio de sus derechos fundamentales.
El destacado Constitucionalista Antonio Enrique Pérez Luño, en su obra: La Seguridad Jurídica, Barcelona, Editorial Ariel S.A., 1991, página 19, nos indica lo siguiente: "La seguridad por inmediata influencia de la filosofía contractualista e iluminista se convertirá en presupuesto y función indispensable de los ordenamientos jurídicos de los Estados de Derecho. Se ha observado, certeramente, que la seguridad jurídica es el factor primario que impulsó a los hombres a constituir una sociedad y un Derecho, o, dicho en términos racionales, lo que constituye el motivo radical y primario de lo jurídico". Según la tesis seguida, la seguridad jurídica va un escalón más allá de los valores concretos establecidos constitucionalmente, y se convierte en un principio englobante para lograr los valores constitucionales, al fomentar el entero orden constitucional, que asegura realización de las libertades individuales.
De lo anterior se desprende claramente, que la seguridad jurídica es un postulado de muy amplia proyección, informador de todo el ordenamiento, y del que se derivan otros principios como el de la protección de la confianza de los administrados y la coherencia en la administración del Estado. Téngase en cuenta, que nuestra argumentación no quiere dar a entender, que la seguridad jurídica se corresponde con la petrificación del ordenamiento, y que las competencias no deben ser actualizadas y asignadas de manera distinta a la ya establecida. sino que se pretende el respeto a las garantías de confianza, seguridad, eficiencia, coherencia y sana administración pública, para que las competencias atiendan a la labor técnica y especializada de cada institución, y que en caso de un cambio en el ordenamiento jurídico este se realice de manera generalizada garantizando la igualdad de los administrados ante el ordenamiento jurídico, y no estableciendo excepciones particulares a las normas jurídicas.
Precisamente en el propio sentido de lo anterior, recuérdese la vigencia del principio de inderogabilidad singular de las normas, que implica la valía de la norma aún para el propio ente que las dictó, lo que de ninguna manera significa que no pueden ser reformadas o cambiadas, sino que garantiza que el posible o hipotético cambio o reforma, deba realizarse de conformidad con los procesos normados al efecto y que sea aplicado para la generalidad de los administrados, evitando las reservas discrecionales de desaplicación de las normas para casos concretos. Frente a lo anterior, el propio ordenamiento jurídico prevé Ia posibilidad de exceptuar el principio señalado, sea esto dado que dentro de la actividad humana pueden existir fallas, errores, o problemas subyacentes, la actividad de gestión administrativa no escapa de tales vicisitudes, siendo así que para esto se planeó dentro de los sistemas jurídicos la posibilidad que los actos administrativos, que sean favorables o declaratorios de derechos a terceros, puedan ser anulados o revisados de oficio.
De cara a esto, nuestro ordenamiento jurídico establece un sistema bipolar de procedimientos anulatorios de los actos propios, concretamente sea lo predispuesto en los artículos 173 de la Ley General de la Administración Pública y el 34 del Código Procesal Contencioso Administrativo. Estos numerales suponen una garantía para los administrados en cuanto si son beneficiarios de un acto administrativo, este no será suprimido sin un juicio previo con todas las garantías del debido proceso, sea un procedimiento administrativo (previo dictamen positivo de un órgano consultor, PGR o CGR, según sea el caso) en el supuesto del articulo 173. o por medio de un proceso judicial en el caso del artículo 34. Así las cosas, si bien por principio general la Administración Pública se encuentra inhibida para anular los propios actos que ha girado en favor de administrados. De la misma forma, ambos procedimientos anulatorios tienen un orden prelativo propio, siendo que en principio cualquier gestión debe cursar por regla general debe acudirse a la vía judicial y solicitar al órgano jurisdiccional el que se declare la nulidad del acto que se pretende lesivo, la razón de esto es limitar la posibilidad de que la Administración anule por sí misma los actos propios es por seguridad jurídica, dado que se pretende que el administrado tenga la certeza de que los actos administrativos que le confieren derechos subjetivos no van a ser modificados, ni dejados sin efectos arbitrariamente por mano propia.
Para nuestro caso particular, importante verificar que. fuera de lo común en la órbita del derecho público costarricense, nuestra Municipalidad declaró la Iesividad de una de sus actuaciones, en plena aplicación del principio de seguridad jurídica, y procurando no generar mayores expectativas en el interesado. En dicho proceso, iniciado mediante el expediente judicial nro. 15-010009-1027-CA, nuestra Corporación Municipal, en un sano ejercicio de diligencia, procedió a declarar la Iesividad, y presentar la gestión judicial, donde tuvo parte la aquí actora, para determinar la eventual nulidad de una actuación. Proceso donde a la Municipalidad no le corresponde la decisión final, sino que esto se encuentra bajo la órbita de un juez de la República. De esta manera, que el cumplimiento de los procesos de autorización que se dan con el cumplimiento del proceso ambiental-urbano tiene un significado per se, en la protección a la naturaleza y evitar el daño a la colectividad que podría generar la falta de pericia técnica en la construcción o modificación de terrenos.
Situación frente a la que, al evidenciarse el riesgo generado hacia el recurso hídrico, la molestia ciudadana y las principales obligaciones de protección ambiental y de resguardo por la legalidad urbanística quebrantada. Sobre los presuntos daños alegados por la parte actora. En el particular nos permitimos manifestar nuestra disconformidad con la estimación de daños patrimoniales, esto pese a que somos conscientes de que no nos encontramos en el momento procesal oportuno al respecto, declarada por la parte actora, esto por cuanto no realizada detalle o desglose alguno, sobre los presuntos daños dentro de su demanda. Adicionalmente, pretende cobrar la totalidad de un fundo o bien inmueble, sin que a la fecha esta Municipalidad, u ente público pretenda negarle el derecho de utilización que tiene sobre la cosa, bien podría la parte actora desarrollar proyectos habitacionales u comerciales, siempre y cuando no riñan con la legalidad urbanística o ambiental.
Adicionalmente. fuera de que la estimación de los presuntos daños es a todas luces arbitraria, rehuye a probarle y abiertamente pretende cobrar items que no se encuentran directa y/o causalmente ligados con los hechos de su demanda. En este sentido solicitamos su rechazo, y que sean expuestas al debido contradictorio.". En conclusiones la representación de la Municipalidad indicó que, no existe un daño material y es improcedente su reconocimiento, realiza manifestaciones en cuanto a las declaraciones del peritaje y los otros testigos, desvirtuándolas y rechaza el daño.-
La responsabilidad civil extracontractual de la Administración Pública, se enmarca, dentro de un régimen objetivo, que engloba en su fundamento tanto la teoría del riesgo, como la teoría del equilibrio en la ecuación patrimonial. Con ello se procura esencialmente, la reparación indemnizatoria a quien ha sufrido una lesión atribuible a la organización pública como centro de autoridad. Este criterio finalista produce a su vez, una transformación plena en el eje central de la responsabilidad misma, pues abandona la observación analítica del sujeto productor del daño y la calificación de su conducta, para ubicarse en la posición de la víctima, que menguada en su situación jurídica, queda eximida en la comprobación de cualquier parámetro subjetivo del agente público actuante (salvo en lo que a su responsabilidad personal se refiere). De conformidad con el régimen objetivo de responsabilidad administrativa establecido en la Constitución Política de la República (artículos 9, párrafo primero, 11, 18, 33, 34, 41, 45, 49 párrafo primero, 139 inciso 4), 140 inciso 8), 148, 188 y 191) y las disposiciones contenidas en los artículos 190 siguientes y concordantes de la Ley General de la Administración Pública, la Administración responderá por todos los daños que cause su funcionamiento legítimo, ilegítimo, normal o anormal, salvo fuerza mayor, culpa de la víctima o hecho de un tercero.
La legitimidad o ilegitimidad se refiere básicamente a la adecuación de la conducta formal de la Administración al ordenamiento jurídico, mientras que la normalidad o anormalidad se refiere ante todo (pero no en forma exclusiva) a la conducta material o técnica, representada entre otras por la actividad prestacional que se atribuye al Estado como un todo. Conforme lo ha señalado la Sala Primera de la Corte Suprema de Justicia en la Sentencia No.000584-F-2005 de las diez horas cuarenta minutos del once de agosto del 2005), la anormalidad atiende a aquellas conductas administrativas, que en sí mismas, se apartan de la buena administración (conforme al concepto utilizado por la Ley General de la Administración Pública en el artículo 102, inciso d) que entre otras cosas incluye la eficacia y la eficiencia) o de la organización, de las reglas técnicas y científicas o de la pericia y el prudente quehacer en el despliegue de sus actuaciones.
La anormalidad se puede manifestar a través de un mal funcionamiento, un funcionamiento tardío o una ausencia total de funcionamiento. En todo caso, debe considerarse que conforme al régimen de responsabilidad contenido en nuestra legislación, la determinación de responsabilidad queda sujeta a la existencia de un nexo de causalidad entre la conducta administrativa y el daño producido, el que deberá ser cierto, efectivo, evaluable, indemnizable y no conjeturable. En consecuencia para su acaecimiento se requiere de tres requisitos esenciales:
Una vez revisados los argumentos de las partes y la prueba que consta en autos, esta Cámara de Juzgadoras determina que el presente asunto debe ser parcialmente declarado con lugar por las razones que a continuación se explican. Haciendo la salvedad de que cualquier argumento novedoso que las partes hayan incluido en conclusiones y que no consten en los escritos de demanda y contestación, no serán analizados porque lo contrario sería violentar los principios de debido proceso y derecho de defensa de las otras partes al no darse un contradictorio.
Los demandados interponen las excepciones de falta de derecho y falta de legitimación activa y pasiva. A la luz de los autos las excepciones de falta de legitimación activa y pasiva deben ser rechazada por cuanto tal y como se indicó en el considerando anterior, la actora gira su demanda a una serie de actuaciones administrativas de las demandadas con las cuales interactuó en la aprobación de un proyecto de construcción. Distinto ocurre con la excepción de falta de derecho, la cual se acoge parcialmente, y solo respecto de la Municipalidad de Vásquez de Coronado, descartando responsabilidad del Estado y del Senara, toda vez que tal y como se indicó en el considerando anterior de la presente resolución, al actor no le asiste la razón en torno al reclamo indemnizatorio respecto de ellas pero si de gobierno local. .-
De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, encuentra este Órgano Colegiado motivo para aplicar las excepciones que fija la normativa aplicable, en lo que corresponde a la Municipalidad de Vásquez de Coronado y la parte actora por cuanto estamos ante un vencimiento recíproco, ya que si bien se concedió un monto por daño patrimonial se rechazó parte de las pretensiones, por lo que ha existido por ambas partes motivo para litigar al asistirle la razón a la Municipalidad en torno a parte del rechazo del reclamo indemnizatorio y al actor respecto a la pretensión relativa a los gastos de la construcción realizada.
Por ende, no se realiza especial condenatoria en costas. Ahora en lo que corresponde al Estado y Senara, no encuentra este Órgano Colegiado motivo para aplicar las excepciones que fija la normativa aplicable, por cuanto como se dijo supra, la parte actora ha perdido esta demanda al no asistirle el derecho respecto de esos demandados; por ende, se condena a la parte actora a pagarle al Estado y a Senara ambas costas del proceso. Asimismo se condena a favor del Estado el pago de intereses sobre las costas desde la firmeza de esta sentencia y hasta su efectivo pago.-
POR TANTO
Se admite la prueba para mejor resolver presentada por la Municipalidad de Vásquez de Coronado. Se rechazan las faltas de legitimación activa y pasiva interpuestas por el Estado y Senara. Se acoge la falta de derecho interpuesta por el Estado y Senara y respecto de la Municipalidad de Vásquez de Coronado, se acoge parcialmente. En consecuencia, se rechaza la demanda en lo que corresponde a los demandados Estado y Senara. Se declara parcialmente con lugar la demanda interpuesta por Inversiones Pelyo del Este S.A. contra la Municipalidad de Vásquez de Coronado. Se condena a la Municipalidad de Vásquez de Coronado al pago del daño material de la sociedad actora, consistente en los gastos en que incurrió en la construcción realizada antes de la paralización de la misma, monto que se determinara en ejecución de sentencia en los términos señalados en el considerando de fondo de esta sentencia, siendo que deberá demostrar los gastos en el período de la construcción -sin incluir los gastos en que incurrió para mitigar el daño ambiental- a través de un peritaje en el que se aporte la prueba contable, financiera o documental que merezca credibilidad al juez ejecutor, y siendo que el monto que se determine se traerá a valor presente; en lo demás, entendiéndase rechazada la demanda en lo no expresamente concedido.
En lo que corresponde a la parte actora y la Municipalidad de Vásquez de Coronado, el asunto se falla sin especial condenatoria en costas. Son las costas a cargo de la parte actora en lo que corresponde al Estado y Senara. Se condena asimismo al pago de intereses sobre las costas otorgadas a la parte actora, a favor del Estado desde la firmeza de esta sentencia y hasta su efectivo pago.
