Criminal case 20-000023-0030-PE brought against [Nombre1], [Nombre1], [Nombre2], and [Nombre3], for the offense of money laundering (Legitimación de capitales) and other offenses against La Administración de Justicia and others.
Appeals from the criminal judgment filed by attorneys Guido Núñez Jarquín, in his capacity as private defense counsel for defendant [Nombre3]; Leonel Villalobos Salazar, in his capacity as private defense counsel for defendants [Nombre1] and [Nombre1], as well as defendant [Nombre2]; Gilberto Villalobos Zamora, in his capacity as co-counsel for defendants [Nombre1] and [Nombre1]; and Esteban Víquez Vargas, representing the Public Prosecutor’s Office (Ministerio Público); as well as the appeal filed personally in their own defense (defensa material) by defendants [Nombre1], [Nombre1], and [Nombre2]. Judges Kenneth Alvarado Aguirre, Adrián Cascante Mora, and [Nombre4] Morales Chinchilla issue this decision; BACKGROUND:
1. By Judgment 170-2021 at fifteen hours and eighteen minutes on nueve de abril de dos mil veintiuno, the Trial Court of the First Judicial Circuit of Zona Sur, Pérez Zeledón seat, ruled: “THEREFORE: In accordance with the foregoing; Articles 39, 41, and 50 of the Political Constitution; Article 8, paragraph 2), of the American Convention on Human Rights; Article 11 of the Universal Declaration of Human Rights; Article 14 of the International Covenant on Civil and Political Rights; the provisions currently in force governing civil liability under the 1941 Criminal Code; Articles 1045 and 1048 of the Civil Code; Executive Decree No. 39078-JP on Attorneys’ Fees, in force at the time of the events; Articles 221 and 222 of the Code of Civil Procedure; Articles 1, 21, 22, 30,31,45, 49 to 51,57, 71 to 76, 227 paragraph 2, 281, and 361 of the Criminal Code; Articles 1, 2, 3, 4, 5, 6, 8, 9, 16, 37,38, 70,75,110,111 to 124,142,184, 200, 258, 265 to 270, 303, 306, 308, and 341 through 368 of the Code of Criminal Procedure; Articles 1 and 3, paragraphs a) and d), of the Organic Law of the Office of the Attorney General of the Republic; Articles 1, 58, 69, 77 paragraph f), 87,90,93, and 94 of the Law on Narcotics, Psychotropic Substances, Unauthorized-Use Drugs, and Related Activities, Law No. 8204; Articles 11, 33, 34, 58 paragraphs a) and b), and 61 paragraph c) of Ley Forestal No. 7575; and Article 9 of the Law Against Organized Crime, Law No. 8754; based on the votes cast and unanimously, [Nombre1] is hereby FOUND to be criminally responsible as the perpetrator of the OFFENSES UNDER LEY FORESTAL, in the forms of ENCROACHMENT UPON A PROTECTED AREA (INVASIÓN EN ÁREA DE PROTECCION), EXPLOITATION (APROVECHAMIENTO), and
ILLEGAL LOGGING OF FOREST RESOURCES AND LAND-USE CHANGE (cambio de uso del suelo), in ideal concurrence (concurso ideal) WITH THE OFFENSE OF USURPATION OF PUBLIC-DOMAIN PROPERTY, which in turn are in material concurrence (concurso material) with the offense of MISUSE OF PUBLIC PROPERTY, AND VIOLATION OF the Law on Narcotic Drugs, Psychotropic Substances, Unauthorized-Use Drugs, and Related Activities, in the forms of CULTIVATION, PREPARATION, EXTRACTION, AND TRANSPORTATION OF CANNABIS SATIVA FOR TRAFFICKING PURPOSES, in its AGGRAVATED form, which in turn is in material concurrence with ONE OFFENSE OF MONEY LAUNDERING, committed to the detriment of NATURAL RESOURCES, PUBLIC HEALTH, THE PUBLIC ADMINISTRATION, and the SOCIOECONOMIC ORDER; accordingly, a sentence of ONE YEAR OF IMPRISONMENT is imposed for the OFFENSES IN VIOLATION OF THE LEY FORESTAL, in the forms of ENCROACHMENT UPON A PROTECTED AREA, EXPLOITATION AND ILLEGAL LOGGING OF FOREST RESOURCES, AND LAND-USE CHANGE, in ideal concurrence with USURPATION OF PUBLIC-DOMAIN PROPERTY; for the offense of MISUSE OF PUBLIC PROPERTY, a sentence of THREE YEARS OF IMPRISONMENT; and TWELVE YEARS OF IMPRISONMENT for the offense of violating the Law on Narcotic Drugs, Psychotropic Substances, Unauthorized-Use Drugs, and Related Activities through the CULTIVATION, PREPARATION, EXTRACTION, AND TRANSPORTATION OF CANNABIS SATIVA FOR TRAFFICKING PURPOSES IN ITS AGGRAVATED FORM; AND TEN YEARS FOR THE OFFENSE OF MONEY LAUNDERING, for a total of TWENTY-SIX YEARS OF IMPRISONMENT. As to the accused [Nombre1] , a sentence of TEN YEARS OF IMPRISONMENT FOR THE OFFENSE OF MONEY LAUNDERING is imposed. [Nombre2] is also found to be a principal responsible for the offense of MONEY LAUNDERING, to the detriment of THE SOCIOECONOMIC ORDER; accordingly, a sentence of TEN YEARS OF IMPRISONMENT is imposed, as well as ONE offense of CRIMINAL ASSOCIATION, to the detriment of PUBLIC TRANQUILITY, for which a sentence of ONE year of imprisonment is imposed, for a total of ELEVEN YEARS OF IMPRISONMENT. [Nombre3] is also found to be a principal responsible for the offense of MONEY LAUNDERING, to the detriment of THE SOCIOECONOMIC ORDER; accordingly, a sentence of TEN YEARS OF IMPRISONMENT is imposed, as well as ONE offense of CRIMINAL ASSOCIATION, to the detriment of PUBLIC TRANQUILITY, for which a sentence of ONE year of imprisonment is imposed, for a total of ELEVEN YEARS OF IMPRISONMENT. All defendants shall serve these sentences in the places and under the conditions prescribed by the applicable prison regulations, with credit for time spent in pretrial detention (prisión preventiva). PURSUANT TO THE UNIVERSAL PRINCIPLE OF IN DUBIO PRO REO, [Nombre5] IS ACQUITTED OF ALL PUNISHMENT AND LIABILITY for all acts charged against him by the Public Prosecution Service. The costs of the private prosecution (querella) are set at SIX HUNDRED THOUSAND COLONES and shall be borne jointly and severally by the defendant in the private prosecution. The Civil Claim for Damages (Acción Civil Resarcitoria), brought by the civil claimant THE STATE, represented by the Procuraduría General de la República (Procuraduría Penal), against the civil defendant [Nombre1] , is granted; accordingly, he is ordered to pay FIVE MILLION TWO HUNDRED THREE THOUSAND TWO HUNDRED SIXTY COLONES (5.203,260,00) for environmental damage, plus legal interest from the date this judgment becomes final until payment in full, as well as costs, which are set at ONE MILLION FORTY THOUSAND SIX HUNDRED FIFTY-TWO COLONES (1,040.652,00), in favor of the State. The Civil Claim for Damages brought by the Procuraduría General de la República (Ética Pública) against the civil defendant [Nombre1] is granted; accordingly, joint and several liability is imposed for payment of the social harm caused, in the amount of FIVE MILLION COLONES. The civil defendants [Nombre1] and [Nombre1] are ordered to pay material damages IN AN AMOUNT TO BE DETERMINED (EN ABSTRACTO), plus legal interest from the date this judgment becomes final until payment in full, in favor of the State. Said civil defendants are ordered to pay both sets of costs in an amount to be determined, in favor of the State; those costs shall be established during enforcement of the judgment (ejecución de sentencia). The civil defendants are advised that they must pay said amounts within fifteen days after this judgment becomes final. As to the seized property, once the judgment becomes final, forfeiture (comiso) in favor of the Instituto Costarricense sobre Drogas is ordered for a Mitsubishi vehicle, Montero Sport GLS body style, license plate [Placa1], model 2016; one gray-and-white Ferton scale with a capacity of 50 kilograms; one medium-sized Detecto scale with a white plastic container; one black cellular phone (DM29) with a gray border, Huawei brand; one blue BlackBerry cellular phone (DM14), CED1, and Claro SIM card; one Toshiba laptop computer (PC01), with its charger, serial number 8B054359Q; and exactly seventy-six thousand four hundred colones (76.400), seized from the convicted person [Nombre1] . The Instituto Costarricense sobre Drogas shall be notified by official communication. Once the judgment becomes final, the following property shall be returned: one Yamaha motorcycle, XTZ125E body style, license plate [Placa2], which shall be returned to its registered owner, the defendant [Nombre5] ; and exactly one hundred forty thousand colones, in favor of the convicted person [Nombre3] . The following items of evidence shall remain in the custody of this court’s property depository and be returned to the Sección Especializada en Cibercrimen: one black Kingstone storage device with a capacity of 64Gb, labeled “63”; one Toshiba hard drive, serial number 5589H94ASTZ5, with a capacity of 2TB, and four backup reports. Once the judgment becomes final, the following evidence shall be destroyed: three plastic bags containing medium-sized plastic bags and one roll of plastic for vacuum sealing; one piece of gray-and-black leak-sealing tape; four transparent vacuum-packaging plastic bags bearing the words “Food Saver”; one Kolbi notebook containing numerical entries and references to floors, consisting of 21 folios; fifteen folios of Ferretería Boston invoices (item of evidence 10), 17 folios containing entries 16 through 32 of Ferretería Palmares invoices (item of evidence 10), 14 folios containing sequential entries 33 through 46 of Coopemadereros R.L invoices (item of evidence 10), 11 folios containing sequential entries 47 through 57 of Ferretería AVM invoices (item of evidence 10), 75 folios containing sequential entries 58 through 72 of invoices from various businesses and hardware stores (item of evidence 10), and three folios containing sequential entries 73 through 75, consisting of money receipts and invoices, all in the name of [Nombre1] (item of evidence 10); one packaged, secured, and sealed plastic bag containing two pieces of paper, both bearing letters, numbers, and names written in blue; one labeled, secured, and sealed plastic bag containing a receipt for money from Motos del Sur, another invoice from Motos del Sur, and a payment voucher for Caja Costarricense del Seguro Social insurance; one folio acknowledging receipt of money and one brown notebook; one labeled, sealed, and secured plastic bag containing miscellaneous documentation (payment receipts to Wilba del Sur S.A); one labeled, sealed, and secured plastic bag containing two folios, an employer-account statement, identification number CED2- ; one labeled, sealed, and secured plastic bag containing eight notebooks and miscellaneous documentation; one labeled, sealed, and secured plastic bag containing eleven vouchers, ten from Banco Nacional and one from Mutual Alajuela, and five money receipts; one labeled, sealed, and secured plastic bag containing a blue Skipper notebook; one labeled, sealed, and secured plastic bag containing a red planner and eleven Banco Nacional vouchers; one transparent plastic bag containing a yellow money-transfer receipt, duly sealed and secured; one labeled, sealed, and secured plastic bag containing a brown planner; one red-and-brown folder bearing the name of the company Veinsa Motors, containing a copy of purchase application number 78726, in the name of [Nombre3] , dated 22 de marzo de 2016, for a gray Mitsubishi vehicle, Sport body style, and four folios of copies of bank deposits from different financial institutions; one operational-post logbook from Estación Biológica Altamira, consisting of two hundred folios; one minute book consisting of two hundred folios; one binder labeled as patrol reports, puesto Pittier; one operational-post logbook from estación Biológica Altamira, corresponding to a 35-folio vehicle-use control notebook, with two detached folios, for vehicle 29-614; one sealed and secured plastic bag containing a vehicle-control form; one chain-of-custody bag containing a vehicle-control notebook titled “Control de uso de vehículos 29-733,” consisting of 20 folios; one sealed and secured plastic bag containing a blue folder with ship designs, various notes, and several folios; and one transparent plastic bag containing a black Blu Mol Life One XL cellular phone (DM16), with number CED3 , a Kolbi SIM card, a Maxell memory card, charger, battery, and rear cover. Pursuant to Article 258 of the Code of Criminal Procedure (Código Procesal Penal), the convicted persons [Nombre2] AND [Nombre3] are ordered held in pretrial detention for a period of SIX MONTHS, running from today, nueve de abril del año 2021, through 09 de octubre del año 2021. All precautionary measures (medidas cautelares) currently in force in this case against [Nombre5] are terminated because a judgment of acquittal has been entered in his favor, unless another case prevents it. The release of the mortgage security established in favor of La Corte Suprema de Justicia, Poder Judicial, legal-entity identification number CED4, in the net amount of Twenty million colones, is ordered. Said mortgage appears registered under Volume: 2016, Entry: 678180 Sequence: 01, Subsequence: 0001, Consecutive Number: 001, against the property located in the Partido de de Puntarenas, registered in the Registro Nacional under the computerized real-property folio system, with registration number: [Placa3]. Once the judgment becomes final, it shall be entered in the Registro Judicial, and the customary certified copies shall be sent to the court for enforcement of sentence and to the Instituto Nacional de Criminología for the matters within their respective authority. That is all. [Nombre6] , [Nombre7] , [Nombre8] , TRIAL JUDGE AND TRIAL JUDGES. (sic).”

I.In compliance with statutory requirements, the appeal (recurso de apelación) filed by attorney Gilberto Villalobos Zamora on behalf of defendants [Nombre1] and [Nombre1] is heard; attorney Leonel Villalobos Salazar, in his capacity as privately retained defense counsel for defendants [Nombre1], [Nombre1], and [Nombre2]; attorney Guido Núñez Jarquín, privately retained defense counsel for defendant [Nombre3]; defendants [Nombre1], [Nombre1], and [Nombre2], exercising their right to self-defense, file an appeal; and finally, attorney Esteban Víquez Vargas, in his capacity as representative of the Ministerio Público, appeals judgment number 170-2021, issued de las quince horas dieciocho minutos del nueve de abril del dos mil veintiuno by the Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, whereby defendant [Nombre1] was found criminally responsible as the principal offender for the offenses of VIOLATION OF THE LEY FORESTAL, in the forms of ENCROACHMENT UPON A PROTECTED AREA, EXPLOITATION AND ILLEGAL LOGGING OF FOREST RESOURCES, AND LAND-USE CHANGE (CAMBIO DE USO DEL SUELO), in ideal concurrence of offenses (concurso ideal) WITH THE OFFENSE OF USURPATION OF PUBLIC-DOMAIN PROPERTY, which in turn are in material concurrence of offenses (concurso material) with the offense of MISUSE OF PUBLIC PROPERTY, AND VIOLATION OF THE Ley Sobre Estupefacientes, Sustancias Psicotrópicas, Drogas de Uso No Autorizado y Actividades Conexas, in the forms of CULTIVATION, PREPARATION, EXTRACTION, AND TRANSPORTATION OF CANNABIS SATIVA FOR TRAFFICKING PURPOSES, IN ITS AGGRAVATED FORM, which in turn is in material concurrence with ONE OFFENSE OF MONEY LAUNDERING, committed to the detriment of NATURAL RESOURCES, PUBLIC HEALTH, PUBLIC ADMINISTRATION, and the SOCIOECONOMIC ORDER; accordingly, he was sentenced to ONE YEAR OF IMPRISONMENT FOR THE OFFENSES OF VIOLATION OF THE LEY FORESTAL, in the forms of ENCROACHMENT UPON A PROTECTED AREA, EXPLOITATION AND ILLEGAL LOGGING OF FOREST RESOURCES, AND LAND-USE CHANGE, in ideal concurrence with USURPATION OF PUBLIC-DOMAIN PROPERTY; THREE YEARS OF IMPRISONMENT for the offense of MISUSE OF PUBLIC PROPERTY; and TWELVE YEARS OF IMPRISONMENT for the offense of violating the Ley Sobre Estupefacientes, Sustancias Psicotrópicas, Drogas de Uso No Autorizado y Actividades Conexas through the CULTIVATION, PREPARATION, EXTRACTION, AND TRANSPORTATION OF CANNABIS SATIVA FOR TRAFFICKING PURPOSES, IN ITS AGGRAVATED FORM; AND TEN YEARS FOR THE OFFENSE OF MONEY LAUNDERING, for a total of TWENTY-SIX YEARS OF IMPRISONMENT.
Defendant [Nombre1] was sentenced to TEN YEARS OF IMPRISONMENT FOR THE OFFENSE OF MONEY LAUNDERING. [Nombre2] was also found criminally responsible as a principal offender for the offense of MONEY LAUNDERING, to the detriment of THE SOCIOECONOMIC ORDER, and was accordingly sentenced to TEN YEARS OF IMPRISONMENT, as well as for one offense of CRIMINAL ASSOCIATION, to the detriment of PUBLIC PEACE, for which she was sentenced to ONE year of imprisonment, for a total of ELEVEN YEARS OF IMPRISONMENT. [Nombre3] was also found criminally responsible as a principal offender for the offense of MONEY LAUNDERING, to the detriment of THE SOCIOECONOMIC ORDER, and was accordingly sentenced to TEN YEARS OF IMPRISONMENT, as well as for one offense of CRIMINAL ASSOCIATION, to the detriment of PUBLIC PEACE, for which she was sentenced to ONE year of imprisonment, for a total of ELEVEN YEARS OF IMPRISONMENT.-
II.The oral hearing concerning the substance of the appeals filed by the parties was held beginning a partir de las las diez horas once minutos del veinte de julio de dos mil veintiuno. In courtroom number six of the Tribunales de Justicia de Cartago building, Judges Kenneth Alvarado Aguirre (presiding), Marco Mairena Navarro, and Jaime Robleto Gutiérrez convened via the Microsoft Teams platform. Participating through the same technological means were attorneys Leonel Villalobos Salazar and Gilberto Villalobos Zamora, as defense counsel and co-counsel, respectively, for defendants [Nombre1] and [Nombre1], and for defendant [Nombre2]; attorney Guido Núñez Jarquín, in his capacity as privately retained defense counsel for defendant [Nombre3]; and attorney Julián Martínez Madriz, representing the Ministerio Público, who was present in the courtroom. All persons deprived of liberty in this case also participated through the Microsoft Teams platform from the Centro de Atención Institucional Antonio Bastida de Paz ([Nombre1] and [Nombre1]) and the Centro de Atención Institucional Vilma Curling Rivera ([Nombre2] and [Nombre3]), where they remain confined. Because the internet system ceased functioning, the continuation was scheduled al ser las ocho horas treinta minutos del veintitrés de julio de dos mil veintiuno, at which time the participation of all parties was confirmed.
III.In the first ground of appeal submitted by attorney Gilberto Villalobos Zamora on behalf of defendants [Nombre1] and [Nombre1], defense counsel alleges that the errors identified in decision 2019-438, issued by the Tribunal de Apelación de Sentencia de Cartago de las diez horas con trece minutos del diecisiete de setiembre del año dos mil diecinueve, were repeated, resulting in an absence of descriptive reasoning (fundamentación descriptiva) in the judgment because it failed to set forth the accounts provided in the testimonial evidence received at trial. He states that the Tribunal de [Nombre9] did not adequately provide descriptive reasoning because the decision contains no logical explanation or reasons why the panel that drafted it decided not to record in the judgment any of the statements made by the witnesses heard at trial. He notes that the witnesses were required to testify only about the facts that the appellate court had requested be clarified and corrected and were not to address matters already settled in the prior judgment.
He asserts that the absence of the witnesses’ testimony from the judgment has made it impossible for the defense to analyze crucial matters such as application of the principle of evidentiary derivation (principio de derivación probatoria), because it limits the defendants’ ability to read the factual and legal reasons for their convictions, thereby hindering both technical defense (defensa técnica) and self-defense (defensa material), since it is impossible to determine whether, in addition to the information selected by the Trial Court, other information favorable to the determination of their criminal liability could be drawn from the witnesses’ testimony. He makes clear that the absence of any reference to the testimony affects 3 aspects: review of the correct application of the principle of evidentiary derivation, because it is impossible to compare whether the statements cited in the section containing the court’s analytical reasoning (fundamentación intelectiva) were made within the proper context of the witness’s testimony; and analysis of the proper application of concurrence rules in the commission of the offense, because testimonial evidence can be used to recreate more closely the circumstances of manner, time, and place in which the punishable conduct was carried out.- In his second ground, defense counsel alleges an absence of legal reasoning (fundamentación jurídica) in the judgment due to failure to comply with the instructions in decision 2019-438 of the Tribunal de Apelación de Sentencia de Cartago, since that decision ordered a proper analysis of the application of concurrence rules in the commission of the offense after determining that there was insufficient clarity as to which doctrine should apply individually and collectively to the criminal acts deemed to have been committed by [Nombre1] and [Nombre1].
Nevertheless, the newly constituted panel of the Criminal Court failed to take into account that this was not a retrial on remand (juicio de reenvío) intended to reassess whether the defendants had participated in the events, but rather a proceeding intended to develop the analysis of the correct doctrine applicable to each act that judgment 21-2019 had found to have been committed. He alleges that the new judgment contains the same deficiency in explaining whether the doctrines of ideal concurrence, material concurrence, and apparent concurrence of statutory provisions (concurso aparente de normas) apply, arguing that the newly constituted Trial Court did not even consider the latter. He complains that the judgment’s analytical-reasoning section does not contain a single line addressing the absorption of offenses that served as a means or path toward achieving the perpetrators’ initially intended objective.
He points to the ultimate and primary purpose for which [Nombre1] and [Nombre1] decided to violate the legal system—whether that purpose was marijuana trafficking as an illicit means of obtaining substantial financial gains—without the necessary analysis of whether the course of that offense entailed the possible commission of other criminal acts that were necessary, within the perpetrators’ plan, to consummate the original offense. He states that the judgment failed to establish whether different perpetrators, many of whom had been convicted in the first judgment, made significant contributions and performed significant functions toward the common objective of the criminal agreement, without addressing whether the discussion should have focused on the circumstances in which the offenses were committed in order to determine whether the defendants committed the charged offenses within a single course of conduct (unidad de acción), as a continuing offense (delito continuado), or as offenses absorbed into more serious criminal conduct.
Finally, he points out that the section of the judgment devoted to determining the existence of an offense is insufficient and fails to explain satisfactorily why the Court again determined and classified the conduct found proven under ideal and material concurrence. Accordingly, the legal reasoning is insufficient as to why ideal concurrence was applied to certain conduct while only other conduct was changed to material concurrence.- In his third ground, defense counsel alleges an absence of descriptive, analytical, and legal reasoning in the determination that [Nombre2] and [Nombre1] were responsible for the offense of Money Laundering. He argues that, specifically with respect to the crime of money laundering, the Trial Court impaired the work of the technical defense and self-defense because its reasoning mentions the statements of Silvia Castro Quesada, who, as a witness and attorney, directed and recorded certain notarial acts.
However, the same defect in the judgment—the failure to transcribe the entirety of the testimony—means that the selective accounts transcribed leave numerous doubts regarding the true circumstances under which the Money Laundering acts occurred, specifically the mortgages on properties belonging to [Nombre1] that were charged against [Nombre1] and [Nombre2] as acts constituting the offense of unlawful concealment of assets (encubrimiento ilícito de bienes). He concludes by stating that one of the principal issues not addressed in the analysis of the money-laundering conduct was whether [Nombre2] had the intent (animus), knowledge, and will to legitimize funds of unlawful origin; it was necessary to establish irrefutably that [Nombre2] was fully conscious of that circumstance and also knew that her conduct was unlawful. The fact that [Nombre2] knowingly and willingly went to Farosa to exchange sums of money, although it was foreign currency, is not sufficient evidence to establish the presence of the subjective and objective elements required by the statutory definition of the offense (tipo penal).
IV.Attorney Leonel Villalobos Salazar, acting as private defense counsel for the defendants [Nombre1] , [Nombre1] and [Nombre2] , files an appeal. In his first ground for appeal, he alleges a violation and failure to observe the right to a defense and due process, because the order of the Cartago Court of Appeal was not followed, insofar as a remand trial (juicio de reenvío) was not held, but rather a new trial.- In his claim, he states that the charge of drug sales is a settled, adjudicated, and concluded matter, and that no ruling could be issued on it at trial, based on the principles of res judicata (cosa juzgada) and legal certainty, because the Trial Court lacked jurisdiction to consider any matter related to drug sales, yet it focused on establishing the existence of a criminal organization involving [Nombre4], Manuel, [Nombre1], [Nombre11] , [Nombre12] , [Nombre13] , [Nombre14] , [Nombre15] and [Nombre16] , an issue already resolved by the Trial Court and affirmed by the Cartago Judgment Appeals Court, thereby resulting in contradictory judgments issued by the same Court with a different panel.
He points out that, as a result of the first judgment and the ruling of the Cartago Criminal Judgment Appeals Court, drug sales were not established in this case; nevertheless, he states that the judgment under appeal finds that the distribution, trade, supply, transportation, and sale of illegal drugs were proven, thereby creating contradictory judgments between judgment number 21-2019 of the Trial Court and number 2019-438 of the Judgment Appeals Court. Furthermore, Manuel Vargas, [Nombre4] Vargas, Luis Tenorio, Jhon Tenorio, Rafael Castro, Ronny Sandí, Mario Beita and [Nombre16] were not present at trial and therefore could not exercise their right to legal and personal defense (defensa técnica y material) regarding the drug-sale charge, which the Court found proven in the judgment even though it was never established, given that res judicata applies with respect to the accused. With regard to the accused [Nombre1] , he alleges that, as clearly established in ruling number 2019-438 of the Criminal Judgment Appeals Court and in judgment number 21-2019 of the Trial Court, [Nombre1] was held criminally liable for violating the Psychotropic Substances Law (ley de psicotrópicos), in the form of drug transportation, for which he was sentenced to eight years’ imprisonment and two years for the offense of unlawful association (asociación ilícita).
He states that the Trial Court disregarded the ruling of the Cartago Criminal Judgment Appeals Court and instead held a new trial concerning [Nombre1] , seeking to establish his participation in the offense of violating the Psychotropic Substances Law, in the form of marijuana cultivation, found him guilty, and increased his sentence to 12 years’ imprisonment, thereby contravening the order in ruling number 2019-438, which declared ineffective the concurrence of offenses (concurso) applied and the sentence imposed for the offenses of drug transportation and unlawful association. He argues that [Nombre1] is being tried for the same acts regarding which a final judgment already exists, when the Court had jurisdiction only to determine the length of the sentence for both offenses, resulting in a judgment that lacks a statement of reasons (fundamentación) concerning [Nombre1]’s participation in the offenses of violating the Forestry Law (ley forestal), in the forms of encroachment upon protected areas (invasión en áreas de protección), unlawful exploitation of forest resources (aprovechamiento ilegal de recurso forestal), land-use change (cambio de Uso de suelo), misappropriation of public resources through use (peculado de uso), and usurpation of public-domain property (usurpación de bienes de dominio público).
He criticizes the judgment for relying on an unproven fact to establish [Nombre1]’s participation in the aforementioned offenses and therefore lacking a statement of reasons, because it violates the principle of logical derivation (principio de derivación lógica), insofar as it is based on the correlation of a series of ambiguous and equivocal indicia (indicios anfibológicos y equívocos) that do not permit the degree of certainty required to issue a conviction. He states that, in this specific case, the conviction is based on an analysis of conversations between third parties in which [Nombre1] is mentioned, without those conversations being consistent with other evidence, and concludes that [Nombre1] participated in the marijuana plantation because the investigating officers interpreted the language used in the wiretaps (intervenciones telefónicas), and because of the Trial Court’s biased and malicious assessment of [Nombre1]’s voice.
He concludes by stating that the judgment incorrectly applies the principles governing circumstantial evidence (prueba indiciaria) and relies on unproven facts and ambiguous and equivocal indicia to conclude that [Nombre1]’s participation in the forestry offenses, misappropriation of public resources through use, and usurpation of public-domain property was established.- With regard to [Nombre1] , he criticizes the fact that, although ruling 2019-438 of the Judgment Appeals Court clearly established that the drug offense had not been proven, neither had his participation in the offense of money laundering (legitimación de capitales), stating that it was necessarily required to prove that the money came from the charged activity of drug cultivation and not from some other uncharged serious offense, since that would violate the principle of correlation between the charge and the judgment (principio de correlación entre acusación y sentencia).
He argues that the Criminal Court should have analyzed whether the money allegedly laundered by the accused came from drug cultivation, a circumstance that was not proven in the judgment under appeal because, according to the rules of logic and experience, the plantation had been cultivated five to six months earlier. It was therefore necessary to analyze whether the actions carried out by [Nombre1] in connection with the money-laundering offense occurred after the plantation had entered production; he refers to the wiretaps of 22 de abril del año 2016,11 y 4 de junio, when the marijuana plantation was not producing and had generated no income, as was also the case on 18, 26 de mayo, 6 y primero de julio, and characterizes the Trial Court’s conclusion concerning the accused [Nombre1] as reckless. The appellant continues by stating that, in the specific case of [Nombre2] , the judgment did not establish that the alleged actions carried out by the accused in connection with money laundering fell within the period in which the marijuana plantation was capable of producing, since the accused created a mortgage (hipoteca) on 21 de octubre del año 2014, a date on which the plantation was not producing; he therefore characterizes the judgment as lacking an adequate statement of reasons.
Finally, the appellant states that the chemical reports (dictámenes químicos) concerning the drug did not establish the THC content of the seized material and that it was not established to the requisite degree of certainty that the legally protected interest (bien jurídico tutelado) of public health had been endangered. It was necessary to demonstrate conclusively, rather than presumptively, through an expert report or laboratory analysis, that the drug had the actual capacity to endanger the legally protected interest of public health, because the judgment bases the conviction on the drug results contained in report number DCF:2106-04106, in which the analytical chemistry section states that the purity level of the cannabis sativa plant material cannot be determined. He states that this deficiency makes it impossible to establish whether the substance is marijuana or hemp and, for the same reason, whether the legally protected interest of public health was endangered, an indispensable requirement for determining whether the Psychotropic Substances Law was violated, since it cannot be established whether the material reaches a concentration of 1%, 10%, or 20%.-
V.Attorney Guido Núñez Jarquín, acting as private defense counsel for the accused [Nombre3] , states in his first ground for appeal that he objects to the violation of the procedural rule contained in Article 363(a) of the Code of Criminal Procedure, because the Judges’ signatures were not obtained. He reports that, on nueve de abril del 2021, the trial concluded and the operative portion of the judgment (parte dispositiva de la sentencia) was issued, with 16 de abril scheduled for the reading of the full judgment; however, on that date, only two of the judges, specifically Jofrey Salas Fuentes and Maureen Castillo Vargas, signed it, and the signature of Judge Leonardo Brenes Gómez does not appear. In his second ground for appeal, he bases his complaint on the determination of the facts found proven in the judgment, which identified [Nombre3] as a member of a criminal organization solely because of the purchase of a vehicle, the payment by installments, and statements made by third parties in a telephone call and voice message, without establishing the unlawful origin of the money.
In his third ground for appeal, he bases his complaint on his disagreement with the determination of the facts found proven, specifically the fourteenth fact, because the judgment attributes her knowledge of the money’s unlawful origin to events occurring after the purchase of the property on 22 de marzo del 2016, specifically the 2015 Mitsubishi vehicle, without any evidence proving that [Nombre3] moved the money to purchase the vehicle or knew of its unlawful origin. In the fourth ground for appeal, the appellant objects to the reasoning and evidentiary analysis (análisis intelectivo y probatorio) concerning [Nombre3] , stating that the conviction was based on the method used to pay for the vehicle, which in itself does not constitute any offense. In the fifth ground for appeal, he states his disagreement with the sentence imposed, asserting that [Nombre3]’s vulnerable condition should have been considered, because she is a young, academically educated person with no prior convictions, who also suffers from lupus and whose family depends on her.
In the sixth ground for appeal, he challenges the Court’s assessment in imposing the precautionary measure (medida cautelar) of pretrial detention (prisión preventiva), on the ground that it lacked a statement of reasons. In the seventh ground for appeal, he bases his complaint on the forfeiture (comiso) of the vehicle because the registered owner did not authorize its improper use and did not know that it would be used to carry out criminal acts. In the eighth and ninth grounds for appeal, the appellant objects to the admission of illegally obtained evidence used by the Court in rendering judgment, specifically the telephone call included in the unnumbered police report located in volume 2, at folio 953, which is not on the Master disc or in the call transcript. Finally, he considers that the officials permitted the commission of the offense by failing to open an investigation despite knowing that they were dealing with a publicly prosecutable offense (delito de acción pública). -
VI.The accused [Nombre1], [Nombre1], and [Nombre2] raise a single ground of appeal (motivo de apelación), alleging a lack of descriptive reasoning (fundamentación descriptiva) in the judgment because none of the statements made by the referenced witnesses were transcribed. They contend that this causes prejudice because they are unable to defend themselves against the conviction, since they cannot challenge the witnesses’ answers to defense counsel’s questions. Their complaint is based on the fact that the judgment transcribes only the portions that interested the Court—a biased and partial account used to convict them—without allowing them to demonstrate, through the defense’s questions, that different conclusions could be reached. They object that, because the statements of the defense witnesses do not appear in the record—including the testimony of [Nombre17], who established the source of the accused persons’ funds—they have been unable to use his testimony in their defense, since it was not transcribed.
VII.Attorney Esteban Víquez Vargas, acting as representative of the Ministerio Público de Pérez Zeledón, filed an appeal. In his first ground of appeal, he challenges the acquittal (absolutoria) entered in favor of [Nombre5], as well as the extent of and basis for the sentence imposed on the accused [Nombre1] and [Nombre1]. He bases his complaint on the absence of analytical and reasoned grounds (fundamentación intelectiva y razonada), because [Nombre5], in addition to having a specific role within the criminal organization, which consisted of acquiring valuable movable property for the purpose of making money obtained from drug-trafficking proceeds appear legitimate, argues that the Court omitted aspects that did not comply with the rules of sound rational judgment (sana crítica racional), without explaining the weight jointly accorded to the circumstantial evidence (indicios).- In the second ground of appeal, he challenges the assessment of the evidence on the basis of erroneous analytical reasoning (fundamentación intelectiva) and violation of the rules of sound rational judgment.
He states that the Court made serious errors, including its treatment of whether the sum of 2900 dollars was substantial for the accused, who reported no salary, had no money in bank accounts, held no interests in companies, and had no movable or immovable property registered in his name. Moreover, in the forensic accounting report (pericia de auditoría contable), the judicial police concluded that his financial profile would not have allowed him to acquire property of that value. Finally, through expert report copy number 024-lofos-2018, a digital fingerprint was obtained and compared with [Nombre5]’s fingerprints, linking him to the possession of drugs and the organization’s illicit business. In his third ground of appeal, he challenges the determination and imposition of the sentence because the judgment was required to address the sentencing grounds applicable to the accused [Nombre1] and [Nombre1] for the offenses adjudicated at the first trial, for which their liability is final.
Nevertheless, with respect to the accused [Nombre1], the Trial Court ruled only on the finding of guilt entered against him for the offense of money laundering (legitimación de capitales), but failed to rule on the imposition of a criminal sentence for all the other offenses for which his liability is final. [Nombre18] argues in the complaint that, with respect to [Nombre1], it is unacceptable that he was given the same sentence despite having engaged in self-laundering (auto legitimador) and having had three nominees (testaferros) within the organization.-
VIII.Having examined the appeals against the judgment submitted for review by this Court, it concludes that the first and third grounds of appeal asserted by attorney Gilberto Villalobos Zamora on behalf of the accused [Nombre1] and [Nombre1], as well as the single ground of appeal asserted by the accused [Nombre1], [Nombre1], and [Nombre2] in the exercise of their personal defense (defensa material), must be sustained for the reasons set forth below.- The Trial Court has broad discretion in structuring the judgment, which, as mandatorily required by Article 363 of the Code of Criminal Procedure (Código Procesal Penal), must always contain the requirements established therein. Subsection b) of that provision establishes a requirement concerning the documentation of the votes of the Judges in the manner in which they were cast during deliberations. To that end, the factual and legal grounds supporting each vote must be set forth, without prejudice, of course, to the authority granted by the provision for the other participating Judges to join the reasoning and conclusions of the Judge who voted first. This subsection in particular must be interpreted systematically in conjunction with the requirements of Article 142 of the same body of law, particularly the requirement to state the factual and legal reasoning on which judicial decisions are based.
IX.In particular, when setting forth the judgment’s factual reasoning, descriptive reasoning must be distinguished from analytical reasoning. The former consists of an explanation, even if succinct, of how the Court, in accordance with the principles of oral proceedings, adversarial process, and particularly immediacy (inmediación), came to understand what those admitted as witnesses stated during the trial, an essential stage of the proceedings. For descriptive reasoning to fulfill its function, the Trial Court must take care to enable the parties, and particularly the accused persons, to conceptually understand the statements made at trial by the accused persons, witnesses, and any expert witnesses who may have participated. Analytical reasoning, in turn, is an intellectual analysis in which the evidence is assessed in accordance with the rules of sound rational judgment. The challenged ruling contains an incurable defect (defecto insubsanable) in its descriptive reasoning: the Trial Court chose to describe the evidence while simultaneously attempting to assess it.
In doing so, the statements were fragmented throughout Considerando 4, entitled “…Assessment of the Evidence and Analysis of the Merits…”. Consequently, the descriptions of the statements made by prosecution witnesses, including officers Leonardo Vargas Marín, Luis Alonso Aguilar Alvarado, and Richard Mena Vargas, are scattered across different portions of that considerando. This fragmentation prevents the description from being understood because its logical unity is lost, thereby making it impossible to exercise adequately the right of defense and, through it, the constitutional principle of due process derived from Article 39 of the Political Constitution (Constitución Política). It bears repeating that this does not entail imposing any particular form of drafting, since each Judicial Body may choose the form it deems most appropriate; however, it cannot disregard the participants’ right to understand the judgment in its entirety.
This is the defect warranting that the appeals be sustained and, consequently, that the appealed judgment and the preceding trial be declared entirely ineffective, and that the pretrial detention order (medida cautelar de prisión preventiva) against the convicted persons [Nombre2] and [Nombre3] be terminated.-
X.Additional note: We, Judges Cascante Mora and Morales Chinchilla, join in the unanimous decision set forth above and consider it important to make the following clarifications regarding the particular case being decided: (i) As recognized in legal scholarship and case law, a judgment constitutes a logical and legal whole and must be considered in its entirety rather than piecemeal, which requires moving beyond rigid templates or formats. Nevertheless, the judgment must be self-contained, so that any reader can ascertain all matters introduced at trial that constitute the evidentiary basis analyzed by the Trial Court. Although trials are ordinarily recorded in audio and video in practice, this does not justify omitting from the judgment any of the matters considered. With respect to testimonial evidence, it is unnecessary to transcribe everything stated by each witness, but the judgment must summarize the substance of the testimony; merely quoting the portions of a statement that support the Trial Court’s decision does not satisfy this requirement.
This factor is especially significant in the present case because the appellants [Nombre1] and [Nombre1], as well as [Nombre2] and [Nombre3], were imprisoned during the period for challenging the judgment, making it difficult for them to access and listen to the testimonial evidence received at trial in order to analyze it in relation to the arguments supporting the Court’s decision. This obstructed the broad exercise of personal defense as an integral element of due process. (ii). In addition to the foregoing, we must state that, in this particular case, the undersigned have verified the existence of prejudice affecting the Right of Defense, Due Process, and this Court’s ability to review the challenged judgment. Some of the grounds asserted in the appeals concern how the Court addressed witness testimony at trial in the face of direct objections by the accused persons’ legal counsel (Defensa Técnica).
The appellants claim that the Trial Court allowed the witnesses to expand their statements substantially, even though certain subjects had been barred when this same Chamber, composed of different judges, ordered the retrial on remand (juicio de reenvío). This manner of drafting prevents the Court of Appeal from determining whether this defect actually occurred because it lacks specific information with which to assess the witnesses’ testimony. This does cause prejudice to the exercise of the Right of Defense and to the Court of Appeal’s ability to review the challenged judgment. As stated above, the judgment must constitute a logical and legal whole and must be self-contained so that the reasoning used by the Trial Court to support its conclusion can be understood and assessed. If one of the participating parties alleges improper examination of the witnesses concerning matters that, according to the claim, were barred from the retrial on remand, this manner of structuring the judgment causes prejudice by preventing this Court from conducting the review required in light of the grounds for challenge asserted by legal counsel and by the accused persons personally.
Por tanto:
In accordance with the foregoing, the first and third grounds of appeal asserted by attorney Gilberto Villalobos Zamora on behalf of the accused [Nombre1] and [Nombre1], and the single ground of appeal asserted by the accused [Nombre1], [Nombre1], and [Nombre2] in the exercise of their personal defense, are sustained. Consequently, the appealed judgment and the preceding trial are declared ineffective, and the case is remanded to the court of origin for new proceedings before a newly constituted panel. Because it is unnecessary, no ruling is made on the remaining grounds of appeal asserted. Documento PJEDITOR Res: 2022-051 Tribunal de Apelación de Sentencia Penal de Cartago. A las quince horas del veintisiete de enero de dos mil veintidós.
Causa penal 20-000023-0030-PE seguida contra [Nombre1] , [Nombre1] , [Nombre2] y [Nombre3] , por el delito de Legitimación de capitales y otros en perjuicio de La Administración de Justicia y otros.
Recursos de apelación de sentencia penal formulados por los Licenciados Guido Núñez Jarquín, en su condición de defensor particular de la encartada [Nombre3] ; Leonel Villalobos Salazar en calidad de defensor particular de los imputados [Nombre1] y [Nombre1] , así como de la endilgada [Nombre2] ; Gilberto Villalobos Zamora, en su condición de co-defensor de los sindicados [Nombre1] y [Nombre1] ; y Esteban Víquez Vargas, en representación del Ministerio Público; así como el interpuesto en su defensa material por los acusados [Nombre1] , [Nombre1] y [Nombre2] . RESULTANDO:
1. Que mediante sentencia 170-2021 de las quince horas dieciocho minutos del nueve de abril de dos mil veintiuno, el Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, sede Pérez Zeledón, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39, 41 y 50, de la Constitución Política, 8 inciso 2) de la Convención Americana de Derechos Humanos, 11 de la Declaración Universal de Derechos Humanos, 14 del Pacto Internacional de Derechos Civiles y Políticos, Reglas vigentes sobre responsabilidad civil del Código Penal de 1941; 1045 y 1048 del Código Civil; Decreto de Honorarios de Abogado número 39078-JP, vigente al momento de los hechos; 221 y 222 del Código Procesal Civil; 1, 21, 22, 30,31,45, 49 a 51,57, 71 a 76, 227 inciso 2, 281 y 361 del Código Penal; 1, 2, 3, 4, 5, 6, 8, 9, 16, 37,38, 70,75,110,111 a 124,142,184, 200, 258, 265 a 270, 303, 306, 308, 341 al 368 del Código Procesal Penal; 1 y 3 incisos a) y d) de la Ley Orgánica de la Procuraduría General de la República; 1, 58, 69, 77 inciso f), 87,90,93 y 94, de la Ley Sobre Estupefacientes, Sustancias Psicotrópicas, Drogas de Uso No Autorizado y Actividades Conexas, ley número 8204; 11, 33, 34, 58 inciso a) y b) y 61 inciso c) de la Ley Forestal número 7575, 9 de la Ley Contra la Delincuencia Organizada, ley número 8754; por el resultado de los votos y por unanimidad se DECLARA a [Nombre1] , autor responsable de los delitos de INFRACCION A LA LEY FORESTAL en las modalidades de INVASIÓN EN ÁREA DE PROTECCION, APROVECHAMIENTO y
TALA ILEGAL DE RECURSO FORESTAL Y CAMBIO DE USO DEL SUELO en concurso ideal CON EL DELITO DE USURPACION DE BIENES DE DOMINIO PUBLICO, que a su vez concursan de manera material con el delito de PECULADO DE USO, E INFRACCIÓN A, Ley Sobre Estupefacientes, Sustancias Psicotrópicas, Drogas de Uso No Autorizado y Actividades Conexas en las modalidades de CULTIVO, PREPARACIÓN, EXTRACCIÓN Y TRANSPORTE DE CANNABIS SATIVA CON FINES DE TRAFICO en forma AGRAVADA, que a su vez concursa de manera material con UN DELITO DE LEGITIMACIÓN DE CAPITALES cometidos en perjuicio de LOS RECURSOS NATURALES, LA SALUD PUBLICA, LA ADMINISTRACION PUBLICA y el ORDEN SOCIOECONOMICO, y en tal sentido se le impone UN AÑO DE PRISON POR LOS DELITOS DE INFRACCION A LA LEY FORESTAL en las modalidades de INVASIÓN EN ÁREA DE PROTECCIÓN, APROVECHAMIENTO Y TALA ILEGAL DE RECURSO FORESTAL Y CAMBIO DE USO DEL SUELO, en concurso ideal con USURPACION DE BIENES DE DOMINIO PUBLICO; por el delito de PECULADO DE USO la pena de TRES AÑOS DE PRISON y DOCE AÑOS DE PRISIÓN por el delito de Infracción a Ley Sobre Estupefacientes, Sustancias Psicotrópicas, Drogas de Uso No Autorizado y Actividades Conexas por CULTIVO, PREPARACIÓN, EXTRACCIÓN Y TRANSPORTE DE CANNABIS SATIVA CON FINES DE TRAFICO EN LA FORMA AGRAVADA; Y DIEZ AÑOS POR EL DELITO DE LEGITIMACION DE CAPITALES, para un total de VEINTISEIS AÑOS DE PRISIÓN. Se declara también a [Nombre2] , autora responsables del delito de LEGITIMACION DE CAPITALES en perjuicio de EL ORDEN SOCIECONOMICO, en tal sentido se le impone el tanto de DIEZ AÑOS DE PRISION y un delito de ASOCIACION ILICITA en perjuicio de LA TRANQUILIDAD PÚBLICA y en tal carácter se le impone UN año de prisión para un total de ONCE AÑOS DE PRISION. Se declara también a [Nombre3] , autora responsables del delito de LEGITIMACION DE CAPITALES en perjuicio de EL ORDEN SOCIECONOMICO, en tal sentido se le impone el tanto de DIEZ AÑOS DE PRISION y un delito de ASOCIACION ILICITA en perjuicio de LA TRANQUILIDAD PÚBLICA y en tal carácter se le impone UN año de prisión para un total de ONCE AÑOS DE PRISION. Penas que deberán descontar todos los imputados en los sitios y formas que determinen los respectivos reglamentos carcelarios previo abono de la preventiva sufrida. EN APLICACIÓN DEL PRINCIPIO UNIVERSAL DE IN DUBIO PRO REO, SE ABSUELVE DE TODA PENA Y RESPONSABILIDAD A [Nombre5] , por todos los hechos que le venía atribuyendo el Ministerio Público. Se fijan las costas de la querella en el monto de SEISCIENTOS MIL COLONES, las cuales están a cargo en forma solidaria del querellado. Se declara con lugar la Acción Civil Resarcitoria, incoada por el actor civil EL ESTADO, presentado por la Procuraduría General de la República (Procuraduría Penal), contra el demandado civil [Nombre1] , y en tal sentido se le condena al pago de CINCO MILLONES DOSCIENTOS TRES MIL DOSCIENTOS SESENTA COLONES(5.203,260,00), del daño ambiental, más los intereses legales apartir de la firmesa de esta sentencia y hasta su efectivo pago; Así como al pago de las costas, las cuales se fijan en UN MILLON CUARENTA MIL SEISCIENTOS CINCUENTA Y DOS COLONES(1,040.652,00), a favor del estado. Se declara con lugar la Acción Civil Resarcitoria, incoada por la Procuraduría General de la República (Ética Pública) contra el demandado civil [Nombre1] , y en tal sentido se les condena en forma solidario al pago del daño social causado por el monto de CINCO MILLONES DE COLONES. En cuanto a los bienes que fueron decomisados, una vez firme la sentencia, se ordena el comiso a favor del Instituto Costarricense sobre Drogas de un vehículo marca Mitsubishi, estilo Montero Sport GLS, placas de circulación [Placa1], modelo 2016, Una romana color gris y blanco marca Ferton, con capacidad para 50 kilogramos, Una romana de tamaño mediana marca Detecto con un recipiente plástico de color blanco, Un celular (DM29) color negro, con borde gris, marca Huawei, Un teléfono celular (DM14) marca BlackBerry, color azul, CED1 y tarjeta SIM Claro. Una computadora portátil (PC01) marca Toshiba, con su cargador, serie 8B054359Q, setenta y seis mil cuatrocientos colones exactos(76.400), decomisados al condenado [Nombre1] . Comuníquese mediante oficio al Instituto Costarricense sobre Drogas. Una vez firme la sentencia se ordena la devolución de los siguientes bienes: una motocicleta, marca Yamaha, estilo XTZ125E, placa de circulación [Placa2] se dispone su devolución a su propietario registral el imputado [Nombre5] y de ciento cuarenta mil colones exactos a favor de la condenada [Nombre3] . Se ordena mantener en custodia de este despacho en el deposito de objetos devolver a la Sección Especializada en Cibercrimen los siguientes indicios:Un dispositivo de almacenamiento marca Kingstone, color negro de 64Gb de capacidad, rotulado “63”. Un disco duro marca Toshiba, serie 5589H94ASTZ5, capacidad de 2TB y cuatro reportes de respaldo. Una vez firme la sentencia se ordena la destrucción de la siguiente evidencia: Tres bolsas plásticas, conteniendo bolsas plásticas de tamaño medio, y un rollo de plástico, para sellar al vacío, Un trozo de cinta tapagoteras, color gris con negro. Cuatro bolsas plásticas transparentes, de empaque al vacío con una leyenda que dice "Food Saver". Una libreta de apuntes marca Kolbi, con anotaciones numéricas, con referencias a pisos con 21 folios. Quince folios de facturas de Ferretería Boston (indicio 10), 17 folios con las consultas del 16 al 32 de facturas de Ferretería Palmares (indicio 10), 14 folios con los consecutivos del 33 al 46 de facturas de Coopemadereros R.L (indicio 10), 11 folios con los consecutivos del 47 al 57 de facturas de Ferretería AVM (indicio 10), 75 folios con los consecutivos del 58 al 72 de facturas de varios comercios y ferreterías (indicio 10), tres folios con los consecutivos del 73 al 75, con recibos por dinero y facturas, todos a nombre de [Nombre1] (indicio 10). Una bolsa plástica embalada, lacrada y sellada, conteniendo dos trozos de papel, ambos con letras, números y nombres, escritos en color azul. Una bolsa plástica, rotulada, lacrada y sellada, conteniendo una factura, por recibo de dinero, de Motos del Sur, otra factura de Motos del Sur y un voucher de pago de seguro de la Caja Costarricense del Seguro Social. Un folio de recibido de dinero y un cuaderno café, una bolsa plástica rotulada, sellada y lacrada, conteniendo documentación varia (recibos de pago a Wilba del Sur S.A). Una bolsa plástica, rotulada, sellada y lacrada, conteniendo dos folios, estado de cuenta orden patronal cédula CED2- . Una bolsa plástica rotulada, sellada y lacrada, conteniendo ocho cuadernos y documentación varia. Una bolsa plástica, rotulada, sellada y lacrada, conteniendo once vouchers, diez del Banco Nacional y uno de Mutual Alajuela y cinco recibos de dinero. Una bolsa plástica rotulada, sellada y lacrada, conteniendo un cuaderno color azul, marca Skipper. Una bolsa plástica, rotulada, sellada y lacrada, conteniendo una agenda de color rojo, y once vouchers del Banco Nacional. Una bolsa plástica transparente, conteniendo un recibo de transferencia de dinero, color amarillo, debidamente sellada y lacrada. Una bolsa plástica rotulada, sellada y lacrada conteniendo una agenda color café. Un folder color rojo con café, con el nombre de la empresa Veinsa Motors, el cual tiene una copia de solicitud de compra número 78726, a nombre de [Nombre3] de fecha 22 de marzo de 2016, del vehículo marca Mitsubishi, estilo Sport, color gris, y cuatro folios de copias de depósitos bancarios de diferentes entidades financierasUn libro de bitácora de puesto operativo, Estación Biológica Altamira, con doscientos folios, un libro de actas con doscientos folios, un ampo, rotulado informes de patrullajes, puesto Pittier, Un libro de bitácora puesto operativo, estación Biológica Altamira, que corresponde a una libreta de control de uso de vehículos de 35 folios, dos despegados, del vehículo 29-614.Una bolsa plástica, sellada y lacrada, conteniendo una boleta de control vehicular.Una bolsa cadena de custodia conteniendo una libreta de control vehicular "Control de uso de vehículos 29-733" de 20 folios. Una bolsa plástica sellada y lacrada, conteniendo un folder de color azul, con estampados de barcos, con apuntes varios y varios folios, una bolsa plástica transparente, conteniendo en su interior un celular (DM16) marca Blu Mol Life One XL, color negro con número de CED3 , con tarjeta SIM Kolbi y tarjeta de memoria marca Maxell cargador y batería, tapa posterior. Con base en lo que establece el artículo 258 del Código Procesal Penal, por un plazo de SEIS MESES que corren a partir de hoy nueve de abril del año 2021 al 09 de octubre del año 2021, se ordena la prisión preventiva de las condenadas [Nombre2] Y [Nombre3] . Se ordena el cese de todas las medidas cautelares vigentes en la presente causa dictadas contra [Nombre5] , por haberse dictado sentencia absolutoria en su favor, si otra causa no lo impide. Se ordena el levantamiento de la garantía real de hipoteca constituida a favor de La Corte Suprema de Justicia, Poder Judicial, cédula jurídica: CED4, por la suma de Veinte millones de colones netos. Hipotéca que aparece inscrita bajo el Tomo: 2016, Asiento: 678180 Secuencia: 01, Subsecuencia: 0001, Consecutivo: 001, sobre la finca del Partido de de Puntarenas, inscrita en el Registro Nacional, bajo el sistema mecanizado de folio real, con matricula número:[Placa3]. Una vez firme la sentencia, inscríbase en el Registro Judicial y envíense los testimonios de estilo para el juzgado de ejecución de la pena y el Instituto Nacional de Criminología, para lo de sus cargos. Redacta el Juez de Apelación de Sentencia Alvarado Aguirre, y
CONSIDERANDO:
I.Por cumplir las exigencias de ley, se conoce del recurso de apelación incoado por el licenciado Gilberto Villalobos Zamora, en favor de los imputados [Nombre1] y [Nombre1] ; El licenciado Leonel Villalobos Salazar, en su condición de defensor particular de los acusados [Nombre1] , [Nombre1] y [Nombre2] ; el licenciado Guido Núñez Jarquín, defensor particular de la imputada [Nombre3] ; Los acusados [Nombre1] , [Nombre1] y [Nombre2] , en el ejercicio de su defensa material interponen apelación; y finalmente el licenciado Esteban Víquez Vargas, en su condición de representante del Ministerio Público, en contra de la sentencia número 170-2021, de las quince horas dieciocho minutos del nueve de abril del dos mil veintiuno, emitida por el Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, mediante la cual se se declara a los acusados [Nombre1] , autor responsable de los delitos de INFRACCIÓN A LA LEY FORESTAL en las modalidades de INVASIÓN EN ÁREA DE PROTECCIÓN, APROVECHAMIENTO y TALA ILEGAL DE RECURSO FORESTAL Y CAMBIO DE USO DEL SUELO en concurso ideal CON EL DELITO DE USURPACIÓN DE BIENES DE DOMINIO PUBLICO, que a su vez concursan de manera material con el delito de PECULADO DE USO, E INFRACCIÓN A, Ley Sobre Estupefacientes, Sustancias Psicotrópicas, Drogas de Uso No Autorizado y Actividades Conexas en las modalidades de CULTIVO, PREPARACIÓN, EXTRACCIÓN Y TRANSPORTE DE CANNABIS SATIVA CON FINES DE TRAFICO en forma AGRAVADA, que a su vez concursa de manera material con UN DELITO DE LEGITIMACIÓN DE CAPITALES cometidos en perjuicio de LOS RECURSOS NATURALES, LA SALUD PUBLICA, LA ADMINISTRACIÓN PUBLICA y el ORDEN SOCIOECONÓMICO, y en tal sentido se le impone UN AÑO DE PRISIÓN POR LOS DELITOS DE INFRACCIÓN A LA LEY FORESTAL en las modalidades de INVASIÓN EN ÁREA DE PROTECCIÓN, APROVECHAMIENTO Y TALA ILEGAL DE RECURSO FORESTAL Y CAMBIO DE USO DEL SUELO, en concurso ideal con USURPACIÓN DE BIENES DE DOMINIO PUBLICO; por el delito de PECULADO DE USO la pena de TRES AÑOS DE PRISIÓN y DOCE AÑOS DE PRISIÓN por el delito de Infracción a Ley Sobre Estupefacientes, Sustancias Psicotrópicas, Drogas de Uso No Autorizado y Actividades Conexas por CULTIVO, PREPARACIÓN, EXTRACCIÓN Y TRANSPORTE DE CANNABIS SATIVA CON FINES DE TRAFICO EN LA FORMA AGRAVADA; Y DIEZ AÑOS POR EL DELITO DE LEGITIMACIÓN DE CAPITALES, para un total de VEINTISÉIS AÑOS DE PRISIÓN.
En cuanto al acusado [Nombre1] , se le impone la pena de DIEZ AÑOS DE PRISIÓN POR EL DELITO DE LEGITIMACIÓN DE CAPITALES. Se declara también a [Nombre2] , autora responsables del delito de LEGITIMACIÓN DE CAPITALES en perjuicio de EL ORDEN SOCIOECONÓMICO, en tal sentido se le impone el tanto de DIEZ AÑOS DE PRISIÓN y un delito de ASOCIACIÓN ILÍCITA en perjuicio de LA TRANQUILIDAD PÚBLICA y en tal carácter se le impone UN año de prisión para un total de ONCE AÑOS DE PRISIÓN. Se declara también a [Nombre3] , autora responsables del delito de LEGITIMACIÓN DE CAPITALES en perjuicio de EL ORDEN SOCIOECONÓMICO, en tal sentido se le impone el tanto de DIEZ AÑOS DE PRISIÓN y un delito de ASOCIACIÓN ILÍCITA en perjuicio de LA TRANQUILIDAD PÚBLICA y en tal carácter se le impone UN año de prisión para un total de ONCE AÑOS DE PRISIÓN.-
II.La audiencia oral para conocer el contenido de los recursos de apelación planteados por las partes se celebró a partir de las las diez horas once minutos del veinte de julio de dos mil veintiuno. En la Sala de debates número seis del edificio de los Tribunales de Justicia de Cartago, se constituyen, mediante la plataforma Microsoft Teams, los jueces Kenneth Alvarado Aguirre (quien preside), Marco Mairena Navarro y Jaime Robleto Gutiérrez. Por medio del mismo mecanismo tecnológico, participan los licenciados Leonel Villalobos Salazar y Gilberto Villalobos Zamora, en calidad de defensor y co - defensor respectivamente de los encartados [Nombre1] y [Nombre1] , y de la imputada [Nombre2] ; el licenciado Guido Núñez Jarquín, en su condición de defensor particular de la encausada [Nombre3] ; así como el licenciado Julián Martínez Madriz en representación del Ministerio Público, quien se encuentra presente en la sala.
Todas las personas privadas de libertad en esta causa intervinieron también mediante la plataforma Microsoft Teams, desde el Centro de Atención Institucional Antonio Bastida de Paz ([Nombre1] y [Nombre1] ) y el Centro de Atención Institucional Vilma Curling Rivera ([Nombre2] y [Nombre3] ), donde permanecen recluidos. En razón de que el sistema de internet, dejó de funcionar, se programó la continuación al ser las ocho horas treinta minutos del veintitrés de julio de dos mil veintiuno, momento en el que constató la participación de la totalidad de las partes.
III.En primer motivo de apelación presentado por el licenciado Gilberto Villalobos Zamora, en favor de los imputados [Nombre1] y [Nombre1] . Alega el defensor que, se repiten los yerros señalados por el voto 2019-438 emitido por el Tribunal de Apelación de Sentencia de Cartago de las diez horas con trece minutos del diecisiete de setiembre del año dos mil diecinueve, incurriendo en ausencia de fundamentación descriptiva de la sentencia, por omitir consignar los relatos de la prueba testimonial recabada en debate. Indica que, el Tribunal de [Nombre9] no hace un adecuado ejercicio de fundamentación descriptiva, ya que la resolución no contiene una explicación lógica o muestra razones por las cuales el grupo redactor, decidió no dejar constando en la sentencia nada de lo declarado por los testigos que se recibieron en el debate. Señala que, los testigos solo deben declarar sobre los hechos que el tribunal de segunda instancia estaba solicitando aclarar y corregir, y no debían referirse a aspectos que ya quedaron zanjados en la anterior sentencia.
Informa que, la ausencia de la declaración de los testigos en la sentencia, ha imposibilitado que la defensa logre analizar aspectos trascendentales como la aplicación del principio de derivación probatoria, esto por cuanto, se limita la posibilidad de los imputados de leer las razones de hecho y derecho por las cuales se les condenó, imposibilitando la defensa técnica y material, al no poderse examinar si, además de los datos seleccionado por el Tribunal de Sentencia, podrían extraerse otros datos de la declaración de los testigos que favorezcan su condición de responsabilidad penal. Deja claro que, la ausencia de la referencia testimonial afecta 3 aspectos: la revisión de la correcta aplicación del principio de derivación probatoria, al no poder cotejar si lo indicado en el apartado de fundamentación intelectiva, es dentro del contexto correcto dentro del cual declaró el testigo; el análisis sobre la aplicación correcta de los concursos en la comisión del delito, por cuanto, a través de la prueba testimonial, se puede recrear de manera más cercana, las circunstancias de modo tiempo y lugar en que se ejecutaron las conductas castigadas.- En su segundo motivo, el defensor reclama ausencia fundamentación jurídica de la sentencia, por inobservancia de lo ordenado en la resolución 2019-438 del Tribunal de Apelación de Sentencia de Cartago, amen que, se dispuso ejecutar un correcto análisis, sobre la aplicación de los concursos en la comisión del delito, todo esto al determinar que no existía la claridad necesaria sobre qué figura debería aplicarse de manera individual y en conjunto por las criminalidades tenidas como cometidas por [Nombre1] y [Nombre1] , no obstante, la nueva integración del Tribunal Penal, no tomó en cuenta que no se estaba en un juicio de reenvío, para valorar nuevamente la participación de los acusados en los hechos o no, sino que era para el desarrollo del análisis sobre la figura correcta aplicable a cada una de las conductas que la sentencia 21-2019, había definido como cometidas.
Acusa que, en la nueva sentencia existe la misma falencia en cuanto a explicar la aplicación o no de las figuras de concurso ideal, material y el concurso aparente de normas, argumentando que este último ni siquiera fue considerado por la nueva integración del Tribunal de Juicio. Denuncia ausencia en el apartado de fundamentación intelectiva de la sentencia, una sola línea que trate el tema de la absorción de los delitos que como medio o camino hacia la consecución del fin inicial perseguido por los autores. Hace ver referencia al fin ulterior y primordial por el cual [Nombre1] y [Nombre1], decidieron infringir el ordenamiento jurídico, si ésta era la actividad de trasiego de marihuana, esto como mecanismo lícito para la obtención de ganancias económicas importantes, sin análisis lo necesario a cerca de si en el recorrido del delito trajo consigo, la posible comisión de otras criminalidades que dentro del plan de autor resultaron necesarias para la consumación del ilícito original.
Señala que faltó establecer si distintos autores, muchos condenados desde la primera sentencia, aportaron ingredientes y funciones significativas para el fin en común del concierto criminal, sin mencionarse si la discusión debía de centrarse sobre las circunstancias de comisión de los delitos a fin de definir si los imputados cometieron los ilícitos achacados dentro de una unidad de acción, delito continuado o dentro de figuras delictivas absorbida dentro de una conducta criminal de mayor relevancia. Finalmente, hace ver que en el apartado de la sentencia dedicado a la determinación de existencia de delito, es insuficiente y no explica de forma satisfactoria las razones por las cuales el Tribunal nuevamente determina y clasifica las conductas tenidas como probadas, dentro de los concursos ideales y materiales, por ello, existe insuficiente razonamiento jurídico, respecto a la explicación necesaria del por qué se aplicó la figura del concurso ideal, para ciertas conductas y solamente se modificó a concurso material para otras.- En su tercer motivo, el defensor denuncia ausencia de fundamentación descriptiva e intelectiva jurídica de la determinación de responsabilidad de [Nombre2] y [Nombre1] , por el delito de Legitimación de Capitales.
Alega que en el caso específico de la criminalidad de legitimación de capitales, el Tribunal de Sentencia, afecta la labor de la defensa técnica y material, por cuanto, menciona en sus razonamientos, el dicho de Silvia Castro Quesada, quien como testigo y abogada que, dirigió y consignó ciertos actos notariales, sin embargo, la misma falencia de la pieza sentenciadora, sobre la no transcripción de la totalidad de los testimonios, causa que los relatos sesgados transcritos, dejen múltiples dudas sobre las verdaderas circunstancias, en que, se desarrollaron las acciones de Legitimación de Capitales, correspondientes a las hipotecas que sobre las propiedades pertenecientes a [Nombre1], se acusaron como propias del delito de encubrimiento ilícito de bienes, en contra de [Nombre1] y [Nombre2]. Finaliza señalando que, dentro de los principales aspectos no tocados en el análisis de la conducta de legitimación de capitales, es si [Nombre2] tuvo animus, conocimiento y voluntad de legalizar dineros de origen ilícito, resultaba necesario definir de manera irrefutable que, esa era una condición plenamente consciente de [Nombre2], y que además conocía la ilicitud de su acción, acreditado el conocimiento y voluntad, con el que [Nombre2] se presentaba a Farosa a cambiar cantidades de dinero, que a pesar de que era moneda extranjera, no es un indicio suficiente para comprobar la presencia de elementos subjetivos y objetivos que el tipo penal requiere.
IV.El licenciado Leonel Villalobos Salazar, en su condición de defensor particular de los acusados [Nombre1] , [Nombre1] y [Nombre2] , presenta recurso de apelación. En su primer motivo de apelación, alega violación e inobservancia del derecho de defensa y debido proceso, toda vez que, no se observó lo ordenado por el Tribunal de Apelación de Cartago, por cuanto no se realizó el juicio de reenvío, sino un nuevo juicio.- Indica en su reclamo que, la acusación por venta de drogas, es un asunto zanjado, resuelto, terminado y en el debate no se podía emitir resolución alguna al respecto, ello con base con el principio de cosa juzgada y de seguridad jurídica, por cuanto, el Tribunal de Juicio, estaba imposibilitado de conocer cualquier asunto relacionado con la venta de drogas, y se preocupó por establecer la existencia de una organización delictiva con la participación en ella de [Nombre4], Manuel, [Nombre1], [Nombre11] , [Nombre12] , [Nombre13] , [Nombre14] , [Nombre15] y [Nombre16] , aspecto ya resuelto por el Tribunal de Juicio, y confirmado, por el Tribunal de Apelación de Sentencia de Cartago, aspecto que produce sentencias contradictorias dictadas por un mismo Tribunal, con integración diferente.
Deja ver que, producto de la primera sentencia y la resolución del Tribunal de Apelación de Sentencia Penal de Cartago, la venta de drogas no se acreditó en esta causa, sin embargo, señala que, en esta sentencia que se apela, se tiene por demostrada la distribución, el comercio, el suministro, transporte y venta de drogas ilícitas, aspectos que generan sentencias contradictorias, entre la sentencia número 21-2019 del Tribunal de juicio y la número 2019-438 del Tribunal de Apelación de Sentencia. Amén de lo anterior los señores Manuel Vargas, [Nombre4] Vargas, Luis Tenorio, Jhon Tenorio, Rafael Castro, Ronny Sandí, Mario Beita y [Nombre16] , no estuvieron presentes en el debate, razón por la cual, no pudieron ejercer su derecho a la defensa técnica y material respecto a la acusación por venta de drogas, la cual el tribunal tiene por acreditada en sentencia, cuando ésta nunca se demostró, considerando que existe cosa juzgada, respecto a los imputados.
Alega con relación al acusado [Nombre1] , que conforme se acredita de manera clara en la resolución número 2019-438 del Tribunal de Apelación de Sentencia Penal, y en como se estableció en la sentencia número 21-2019 del Tribunal de juicio, la responsabilidad penal de [Nombre1], por infracción a la ley de psicotrópicos, en la modalidad de transporte de droga, por lo cual, se le impuso la pena de ocho años de prisión y dos años por el delito de asociación ilícita. Informa que el Tribunal de Juicio inobservó lo resuelto, por el Tribunal de Apelación de Sentencia Penal de Cartago, y en su lugar, realizó un nuevo debate, sobre el caso de [Nombre1] , tendiente a demostrar, su participación en el delito de infracción a la ley de psicotrópicos, en la modalidad de cultivo de marihuana, encontrándole culpable, y, le aumenta la pena a 12 años de prisión, contrariando con ello lo ordenado en la resolución número 2019-438, que declaró la ineficacia del concurso aplicado, de la pena fijada, por los delitos de transporte de droga y asociación ilícita, argumenta que [Nombre1] está siendo juzgado por los mismos hechos, sobre los cuales existe una sentencia firme, siendo que el tribunal sólo tenía competencia para fijar el monto de la pena, con relación a ambos delitos, que produce que la sentencia carezca de la fundamentación, respecto a la participación de [Nombre1] en los delitos de Infracción a la ley forestal, en las modalidades de invasión en áreas de protección, aprovechamiento ilegal de recurso forestal, cambio de Uso de suelo, peculado de uso y usurpación de bienes de dominio público.
Critica que la sentencia parte de un hecho no demostrado para probar la participación de [Nombre1] en los delitos referidos, y por ello, carece de fundamentación, pues se violenta el principio de derivación lógica, en el tanto que se basa en la relación de una serie de indicios anfibológicos y equívocos los cuales no permiten arribar al grado de certeza requerido para el dictado de una sentencia condenatoria. Señala que en este caso concreto la condenatoria, se basa en el análisis de conversaciones entre terceros, en las que se menciona a [Nombre1], sin que dichas conversaciones resulten contestes con otros elementos de prueba, y concluye que [Nombre1] participó en la plantación de marihuana, porque los oficiales de investigación realizan una interpretación del lenguaje utilizado en las intervenciones telefónicas, y a partir de una valoración sesgada y malintencionada qué realiza el Tribunal de la voz de [Nombre1].
Finaliza, señalando que la sentencia, aplica incorrectamente los principios de la prueba indiciaria, parte de hechos no demostrados, de indicios anfibológicos y equívocos para arribar que se tiene por acreditado la participación de [Nombre1] en los delitos forestales, peculado de uso y usurpación de bienes de dominio público.- Con relación a [Nombre1] , fustiga que pese a que se acredita de manera clara, en la resolución 2019-438 del Tribunal de Apelación de Sentencia, el delito de drogas no fue acreditado, tampoco su participación en el delito de legitimación de capitales, indicando que necesariamente, debía acreditarse que el dinero, provenía de la actividad acusada del cultivo de droga y no en ningún otro delito grave no acusado, pues ello violentaría en principio de correlación entre acusación y sentencia. Argumenta que el Tribunal Penal, debió analizar, si el dinero que supuestamente legitiman los imputados proviene del cultivo de droga, situación que no se logró acreditar en la sentencia recurrida, por cuanto según las reglas de la lógica y la experiencia, esa plantación, tenía de cinco a seis meses de haber sido cultivada, debiéndose analizar, si las acciones ejecutadas por [Nombre1], respecto al delito de legitimación de capitales, fueron a partir de si la plantación estuvo en producción, y refiere que las intervenciones telefónicas de 22 de abril del año 2016,11 y 4 de junio, la plantación de marihuana, no estaba produciendo y no había generado ingreso, así como tampoco, para los días 18, 26 de mayo, 6 y primero de julio, calificando la conclusión del Tribunal de Juicio como temeraria con relación al acusado [Nombre1].
Continúa el apelante señalando que en el caso específico de [Nombre2] , no se estableció en sentencia que las supuestas acciones ejecutadas por la imputada respecto al lavado de dinero, se enmarquen dentro del período en que la plantación de marihuana estuviera en capacidad de producción, por cuanto, la imputada constituyó, una hipoteca el día 21 de octubre del año 2014, fecha para la cual la plantación no producía, por lo que califica de carente de la debida fundamentación. Finalmente, el apelante señala que los dictámenes químicos de la droga, no establecieron el contenido de thc del material decomisado, no se establece en grado de certeza que se haya puesto en peligro el bien jurídico tutelado de la salud pública, debiendo demostrarse de manera conclusiva y no presuntiva, mediante un dictamen o análisis de laboratorio, que la droga posee capacidad efectiva, de poner en peligro el bien jurídico tutelado de la salud pública, ello por cuanto, la sentencia basa la condenatoria, sobre los resultados de la droga, contenido en el dictamen número DCF:2106-04106, el cual establece por parte de la sección de química analítica que no se puede determinar el grado de pureza del material de la planta cannabis sativa.
Señala que dicha falencia, no permite establecer si se trata de marihuana o cáñamo, tampoco permite establecer por esta misma razón si se puso en peligro el bien jurídico tutelado de la salud pública requisito indispensable para establecer si se infringió o no la ley de psicotrópicos, por cuanto, no se logra establecer, sí dicho material alcanza un 1% de concentración, 10% o 20%.-
V.El licenciado Guido Núñez Jarquín, en su condición de defensor particular de la imputada [Nombre3] , en su primer motivo de apelación, señala inconformidad por violación a la norma procesal contenida en el artículo 363 inciso a) del Código Procesal Penal, al no cumplirse con la firma de los Jueces. Informa que al día nueve de abril del 2021, se cerró el debate, fue dictada la parte dispositiva de la sentencia, señalando para el día 16 de abril para la lectura integral, siendo que en esta fecha solo firmaron dos de los jueces propiamente Jofrey Salas Fuentes y Maureen Castillo Vargas, sin que conste la firma del Juez Leonardo Brenes Gómez. En su segundo motivo de apelación, sustenta su queja con la determinación de los hechos tenidos por probados de la sentencia, al señalar a [Nombre3] , como parte de una organización criminal únicamente por la compra de un vehículo, el pago fraccionado, y lo expuesto por terceros en una llamada y mensaje de voz, sin que se logre establecer, el origen ilícito del dinero.
En su tercer motivo de apelación, fundamenta su queja en la inconformidad con la determinación de los hechos tenidos por probados, específicamente el décimo cuarto, ya que, remiten el conocimiento y el origen ilícito del dinero a hechos posteriores a la compra del bien inmueble el 22 de marzo del 2016 propiamente el vehículo marca Mitsubishi modelo 2015, sin que exista prueba que compruebe, que el movimiento de dinero, por parte de [Nombre3] , para la compra del vehículo, ni que conociera el origen ilícito. En el cuarto motivo de apelación, el apelante reclama inconformidad en cuanto al análisis intelectivo y probatorio con relación a [Nombre3] , señalando que, para condenar, se basó en la forma de pago del vehículo, lo cual por sí solo, no constituye delito alguno. En el quinto motivo de apelación, fija su inconformidad, con la fijación de la pena, indicando que debió valorarse el estado de vulnerabilidad de [Nombre3] , por ser una persona joven, con preparación académica, y no posee juzgamientos, al mismo tiempo que padece de lupus, y su familia depende de ella.
En el sexto motivo de apelación, se queja de la valoración del tribunal, al imponer la medida cautelar de prisión preventiva, por carecer de fundamento. En el séptimo motivo de apelación, finca su queja con relación al comiso del vehículo, por cuento, la dueña registral, no autorizó el uso indebido del mismo, desconociéndose que se utilizará que se realizar acciones delictivas. El octavo y noveno motivo de apelación, señala el apelante, la inconformidad en cuanto a la incorporación de la prueba obtenida de forma ilegal y utilizada por el tribunal para sentenciar, propiamente la llamada incluida en el informe policial, sin número, que se encuentra en el tomo 2, al folio 953, que no está en el disco Master ni en la transcripción de llamadas. Finalmente, considera que permitió la comisión del delito, por parte de los funcionarios, que conociendo que estaban en presencia de un delito de acción pública, no iniciaron una investigación. -
VI.Los imputados [Nombre1] , [Nombre1] y [Nombre2] , interponen un único motivo de apelación, alegando falta de fundamentación descriptiva de la sentencia, por no existir transcripción alguna de las declaraciones de los testigos referidos, señalando que tal situación causa agravio, al no poder ejercer su defensa contra la sentencia condenatoria, esto por cuanto, no se permite atacar, lo que preguntaron los defensores a los testigos, fincando su queja en que solo se transcribe, la parte que le interesa el tribunal en la sentencia, versión sesgada y parcializadas que, utilizan para condenar, sin que se pueda demostrar a través de las preguntas de la defensa, se puede arribar a conclusiones diferentes. Echan de menos que, al no constar, el dicho de los testigos de la defensa, entre ellos la declaración de [Nombre17] , el cual, acreditó el origen de los fondos de los acusados, su dicho, no la han podido utilizar en su defensa, pues no está transcrita.
VII.El licenciado Esteban Víquez Vargas, en su condición de representante del Ministerio Público de Pérez Zeledón, interpuso recurso de apelación, denunciando en su primer motivo de apelación, inconformidad con la absolutoria dictada a favor de [Nombre5] , así como el monto y sustento de la pena impuesta, a los imputados [Nombre1] y [Nombre1] . Sustenta su queja por carencia de fundamentación intelectiva y razonada, por cuanto, éste, además de una función específica, dentro de la organización criminal, la cual consistió en la adquisición de un bien mueble de alto valor, ello con la finalidad de darle apariencia legítima al dinero obtenido como producto de las ganancias del narcotráfico, hecha de menos que el tribunal omitió aspectos que, no atendieron a las reglas de la sana crítica racional, sin que justificara el valor otorgado a los indicios de forma conjunta.- En el segundo motivo de apelación, alega inconformidad con la valoración de la prueba, por errónea fundamentación intelectiva y violación a las reglas de la sana crítica, por cuanto señala que, el Tribunal incurre, en errores graves, como que, si la suma de 2900 dólares, son una suma cuantiosa para el imputado, quien no reporta salario, no tiene dinero en cuentas bancarias, no participa en sociedades, no tiene bienes muebles, ni inmuebles inscritos a su nombre, y en la pericia de auditoría contable, la policía judicial, concluyó que su perfil económico no le permitiría adquirir bienes de ese valor económico, y finalmente con el dictamen de las copia número 024-lofos-2018, se realizó un levantamiento digital, lográndose comparar con las huellas dactilares de [Nombre5] , relacionándolo con la posesión de droga y el negocio ilícito que realizaba la organización.
En su tercer motivo de apelación, reclama inconformidad con la determinación y la fijación de la pena, por cuanto, correspondía pronunciarse en sentencia sobre la fundamentación de pena de los imputados [Nombre1] y [Nombre1] por los delitos que fueron sentenciados en el primer debate y cuya responsabilidad está firme. No obstante, respecto al acusado [Nombre1] , el Tribunal de Juicio únicamente, se pronunció respecto al juicio de culpabilidad, que se estableció en su contra por el delito de legitimación de capitales, pero omitió pronunciarse sobre la fijación de la sanción penal respecto a todos los demás delitos cuya responsabilidad se encuentra firme. [Nombre18] en su queja que, con relación a [Nombre1] , no resulta de recibo que, habiendo realizado como auto legitimador, que tuvo tres testaferros dentro de la organización, le impusiese la misma sanción. -
VIII.Examinados los recursos de apelación de sentencia sometidos al conocimiento de este Tribunal, se concluye, que han de prosperar el primero y tercer motivo de apelación formulado por el licenciado Gilberto Villalobos Zamora, en representación de los acusados [Nombre1] y [Nombre1] ; el único motivo de apelación formulado por los acusados [Nombre1] , [Nombre1] y [Nombre2] , en el ejercicio de su defensa material, por las razones que de seguido se pasan a enunciar.- El Tribunal de juicio cuenta con una amplia discrecionalidad para estructurar la sentencia, la cual por imperativo ineludible del artículo 363 del Código Procesal Penal, siempre ha de contener los requisitos ahí establecidos. El inciso b), de la norma que se comenta establece una exigencia en torno a la documentación del voto de las Personas Juzgadoras en la forma en que fueron planteadas durante la deliberación. A tal fin, es necesario que se realice una exposición de los motivos de hecho y de derecho en que se han fundamentado cada uno de los votos, claro está, sin perjuicio de la facultad que la norma otorga, para que las otras Personas Juzgadoras intervinientes, se adhieran a las consideraciones y conclusiones de quien votó en primer término.
Este inciso en particular, debe ser sistemáticamente interpretado, con las exigencias del ordinal 142 del mismo cuerpo de leyes, particularmente, en cuanto a la necesidad de expresar los razonamientos de hecho y derecho en que se basan las decisiones judiciales.
IX.En particular, cuando se trata de la exposición de los razonamientos de hecho de la sentencia, es necesario distinguir, la fundamentación descriptiva de la fundamentación analítica o intelectiva. La primera consiste en una exposición, aún sucinta de la forma en que el Tribunal, conforme a los principios de oralidad, contradicción y particularmente de inmediación, logró la comprensión de lo que, quienes fueron admitidos como testigos, declararon durante el juicio, fase esencial del proceso. Para que la fundamentación descriptiva cumpla su función, es necesario que el Tribunal de Juicio se esmere en posibilitar a las partes, pero particularmente a las personas imputadas, la comprensión conceptual de lo declarado en el debate, tanto por las personas imputadas, los testigos y los peritos que eventualmente hayan intervenido. La fundamentación analítica, por su parte, es un razonamiento intelectivo en el que se realiza la valoración de los medios de prueba conforme a las reglas de la sana critica racional.
Es en la fundamentación descriptiva donde se encuentra un defecto insubsanable del fallo recurrido: El Tribunal de Juicio, optó por procurar describir la prueba al mismo tiempo que intentaba realizar su valoración. En ese esfuerzo, se produce la fragmentación de las declaraciones a lo largo del Considerando 4, denominado “…Valoración de la prueba y análisis de fondo…”. Con ello, se difumina en distintos partes de dicho considerando la descripción de lo que dijeron testigos de cargo, como fueron los oficiales Leonardo Vargas Marín, Luis Alonso Aguilar Alvarado y Richard Mena Vargas. Esa fragmentación, impide la comprensión de la descripción, pues se pierde su unidad lógica y con ello se imposibilita el ejercicio adecuado del derecho de defensa, y por esa vía del principio constitucional del debido proceso, derivado del artículo 39 de la Constitución Política. Se reitera, que no se trata de la imposición de una forma de redacción particular, pues cada Órgano Jurisdiccional, puede escoger la forma que estime más conveniente, pero lo que no puede desconocer es el derecho que le asiste a los intervinientes de comprender íntegramente la sentencia y de ahí radica el vicio que amerita que los recursos planteados sean declarados con lugar, declarándose como su consecuencia la ineficacia total de la sentencia apelada y del debate que le antecedió, así como el cese de la medida cautelar de prisión preventiva de las condenadas [Nombre2] y [Nombre3] . -
X.Nota adicional: Los Jueces Cascante Mora y Morales Chinchilla, concurrimos con la decisión unánime expuesta, estimando importante hacer las siguientes precisiones en relación al caso particular que se resuelve: (i) Tal y como ha sido reconocido a nivel doctrinal y jurisprudencial, la sentencia constituye una unidad lógico jurídica, debiendo ser considerada en su integralidad y no de manera fraccionada, lo cual implica superar esquemas o formatos únicos. No obstante ello, la sentencia debe bastarse a sí misma, debiendo resultar posible conocer para cualquier lector todos aquéllos aspectos que fueron introducidos al debate y que constituyen la base probatoria objeto de análisis del tribunal de sentencia. Si bien es cierto, a nivel práctico los juicios quedan registrados normalmente en audio y vídeo, ello no justifica la omisión de introducir todos los elementos de juicio dentro de la sentencia.
En lo que toca a la prueba testimonial, no es necesario una transcripción de todo lo manifestado por cada uno de los testigos, pero sí un resumen del contenido del testimonio, lo cual no se cumple con citar únicamente los extractos de la declaración que amparan la decisión del tribunal de sentencia. Este elemento juega especial relevancia en el caso que nos ocupa, puesto que los recurrentes [Nombre1] y [Nombre1] , así como [Nombre2] y [Nombre3] , se encontraron en prisión durante el plazo de impugnación de la sentencia, lo cual dificulta acceder a escuchar la prueba testimonial recibida en juicio para analizarla en relación a los argumentos que sustentan la decisión del tribunal, obstruyéndose de esta manera un ejercicio amplio de la defensa material como elemento integrante del debido proceso. (ii). Adicionalmente a lo indicado, debemos referir que en este caso concreto se ha verificado por parte de los suscritos la existencia de un agravio, que afecta el Derecho de Defensa, el Debido Proceso y la posibilidad que tiene este Tribunal de examinar la sentencia impugnada; algunos de los motivos alegados en los recursos de Apelación se relacionan con la forma en que el Tribunal abordó la declaración de los testigos en debate, ante objeciones directas de la Defensa Técnica de las personas imputadas; según se reclama el Tribunal de Juicio permitió una ampliación importante de sus declaraciones, cuando algunos temas habían sido vedados al ordenarse el juicio de reenvío por parte de esta misma Cámara con una integración diferente; ahora bien esta forma de redacción impide al Tribunal de Apelación de Sentencia valorar si efectivamente ocurre este vicio, al no tener datos concretos para valorar el testimonio de los testigos; esto precisamente sí genera un agravio al ejercicio del Derecho de Defensa, y a la posibilidad de control que el Tribunal de Apelación debe tener de la sentencia impugnada; como se indicó líneas arriba la misma debe ser una unidad lógica jurídica y debe bastarse a si misma para permitir conocer y valorar la argumentación utilizada para sostener la conclusión que se alcanzó por parte del Tribunal de Sentencia; si una de las partes intervinientes reclama un interrogatorio indebido de los testigos sobre temas que fueron, según se reclama, vedados para el Juicio de Reenvío, esta forma de estructurar la sentencia genera un agravio al impedir el control que debe realizar este Tribunal de la misma, frente a los motivos de impugnación de la defensa técnica y material.
Por tanto:
De conformidad con lo expuesto, se declaran con lugar el primero y tercer motivo de apelación formulado por el licenciado Gilberto Villalobos Zamora, en representación de los acusados [Nombre1] y [Nombre1] ; el único motivo de apelación formulado por los acusados [Nombre1] , [Nombre1] y [Nombre2] , en el ejercicio de su defensa material, y en consecuencia, se declara la ineficacia de la sentencia apelada, y del debate que le precedió, ordenándose el reenvío de la causa al Tribunal de origen para que, con una nueva integración se realice la nueva sustanciación. Por innecesario, se omite pronunciamiento con relación al resto de los motivos de apelación planteados.
