CONSIDERING:

I. REGARDING THE CLAIM

The plaintiff requests that the judgment declare: “Principal claims: 1) …that the defendant be ordered to fell the trees in question (five) within a reasonable period to be established by this Court. 2) That if the defendant does not proceed with the felling (corta) of the trees within the established period, the plaintiff be immediately authorized to perform such work, the costs of which shall subsequently be recovered in Enforcement of Judgment (Ejecución de Sentencia). 3) In the event of opposition, that the defendant be ordered to pay both categories of legal costs (ambas costas). Alternative claims: 1) …that the defendant be ordered to prune the trees in question within a reasonable period to be established by this Court. 2) That if the defendant does not proceed with the pruning (poda) of the tree within the established period, the plaintiff be immediately authorized to perform such work, the costs of which shall subsequently be recovered in Enforcement of Judgment. 3) In the event of opposition, that the defendant be ordered to pay both categories of legal costs” (pleadings section: file 21/10/2020 03:40:28).

II. REGARDING THE ANSWER

The defendant denied the claim without raising defenses, but alleges that felling the trees, because they are located at a spring (naciente), would cause environmental harm. Furthermore, the nearby houses are less than 15 years old and are located only 10 meters from the spring. The leaves fall into the gutters because the protection area (área de protección) is not being respected, but that harm is not grounds for felling the trees. Because they pose no danger to human life and given the location of the buildings, she requests dismissal of the claim (pleadings section: file 13/11/2020 02:47:51). The Procuraduría General de la República (PGR) did not oppose the claim (pleadings section: file 16/11/2020 at 01:38:08).

III. JUDGMENT ON APPEAL

Judge Yeison Rodríguez Fernández, of the Juzgado Agrario de Turrialba, ruled as follows in judgment 70 of 3 de agosto de 2021: “In view of the foregoing and the cited regulations, the present summary action for tree removal filed by [Nombre1] against [Nombre2] is GRANTED as follows: Defendant [Nombre2] is ordered to completely fell the two Eucalyptus trees that are the subject of these proceedings and that were duly marked with the numbers one and two in blue paint, and to perform extensive pruning of the Coral tree and the two Balsa trees that are the subject of these proceedings and that were duly marked with the numbers three, four and five in blue paint; said trees are planted on her property registered in the province of Cartago under registration number CED4 - [Dirección1] , which is located in Pavones de Turrialba. The felling and pruning work shall be performed by the defendant within FIVE DAYS after this judgment becomes final; if such work is not performed within the established period, plaintiff [Nombre1] is authorized to perform it.

The expenses of removing the trees shall be borne by the defendant, who must also take all safety and technical measures necessary to prevent harm to third parties and avoid unnecessary harm to the environment and the natural resources of the surrounding area, which shall be affected only to the extent strictly necessary, and must comply with the other recommendations set forth in the MINAE report. Where applicable, she must notify any third parties who could be affected by a falling branch. The defendant shall replace the trees authorized for felling with small-growing native species, which shall be planted in areas of interest where they will help ensure conservation of the soil and the water-resource protection area (área de protección hídrica). If the interested party wishes to utilize the products resulting from the trees to be felled and pruned, that party shall complete the corresponding procedures before the administrative authority to obtain permits for their extraction, sawing, and transportation, and shall bear the respective costs generated by that work.

No special award of legal costs is made. This matter is ordered brought to the attention of the Ministerio Público so that it may investigate the possible commission of an offense involving encroachment upon a water-resource protection area.- Once this judgment becomes final, a copy shall be sent, for purposes of the authorizations granted and for action within its jurisdiction, to the Oficina Regional del MINAE en Turrialba, which is ordered to monitor and oversee compliance with the provisions of this judgment; such authorization is limited to ensuring that no trees other than the five permitted under this decision are felled or pruned, as well as to issuing permits and tags for transporting the trees whose felling was authorized or their forest products, if required. Let notice be given” (associated documents section: file 03/08/2021 14:10:28).

IV. REGARDING THE PROVEN AND UNPROVEN FACTS

The Tribunal agrees with the proven facts because they are supported by the evidence, except for the third, which concerns a procedural act. The following is added to the fourth: The SINAC technical report further specifies that pruning would not be appropriate for trees 1 and 2 because they are very tall and would prolong the danger; extensive pruning is appropriate for trees 3, 4, and 5 because of their height. Pruning would eliminate the danger temporarily, since these trees will grow again. The following facts are added: Sixth: The spring within whose protection area the trees at issue in these proceedings are located has sufficient flow to supplement the nearby aqueducts; therefore, the land on which it is located has a high degree of water-resource vulnerability (fragilidad hídrica), in addition to being situated in the upper section of the Río Jabillos sub-basin of the Río Reventazón-Parismina basin (see report of the Instituto Costarricense de Acueductos y Alcantarillados, official letter UEN-GA-2021-01454 of 14 de junio de 2021, issued by the Área Funcional de Cuencas Hidrográficas).

V. APPEAL

The defendant appeals on the following grounds, summarized for purposes of analysis: The evidence was improperly assessed. She alleges that the report of the Sistema nacional de Áreas de Conservación, Área de Conservación Central, document SINAC-ACC-OT-1563-2020, prepared by Engineer Freddy Pizarro Arias, Encargado Desarrollo Forestal de la Oficina de Turrialba-Jiménez-MINAE, establishes that all the trees are located within the spring’s protection area, a body of water with [Dirección2] . Furthermore, they are all alive, in fair condition, and have regenerated naturally within the water-resource protection area. Third, the four homes are located within the spring’s protection radius, at distances ranging from 8,04 meters to 49,72 meters, disregarding and encroaching upon the protection area regulated by Ley 7575. Authorizing the possible felling or pruning of the trees could in fact reduce the opportunity for rainwater infiltration during the rainy season, because the absence or reduction of forest cover (cobertura boscosa) does not promote the aquifer-recharge process (proceso de recarga acuífera); on the contrary, it promotes increased surface runoff and the resulting erosion processes or, in the worst case, could cause the spring to dry up.

Regarding the right to a healthy and ecologically balanced environment. Article 50 of the Constitución Política recognizes that “everyone has the right to a healthy and ecologically balanced environment.” The primary objective of using and protecting the environment is to achieve development and progress favorable to human beings. Environmental quality is a fundamental measure of quality of life, as are health, food, work, housing, and education, among others. Although human beings have the right to use the environment for their own development, they also have the duty to protect and preserve it for future generations because, under the principle of “harm” (principio de “lesión”), the lawful exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself. Likewise, the State has the obligation to ensure the conservation, protection, and proper administration of natural resources and the environment in general.

She objects to the manner in which the Juzgado ruled, which she claims causes serious harm to her and to the environment, because felling the trees would reduce water infiltration, thereby impeding the aquifer-recharge process and consequently causing the spring to dry up. She requests that the appeal be granted (pleadings section: file 11/08/2021 10:23:01).

VI.With regard to the subject matter of the appeal, it is important to bear in mind that the purpose of the demolition or felling proceeding (proceso de derribo) is to determine whether a tree or structure, because of its poor condition, poses an imminent danger of falling that could affect the life and safety of persons, their property, or publicly owned assets (sections 310 of the Civil Code and 108 of the Code of Civil Procedure, applied supplementarily). The summary nature of that proceeding seeks to determine whether the structure or tree must be secured (e.g., by means of anchors, supports, etc.), modified (as occurs when the pruning of a tree is authorized), or removed (by demolition or felling, for example), in order to prevent a harmful event that, if those measures are not taken, is highly likely (imminently) to occur now or in the very near future. The prerequisites for this type of proceeding are therefore that the following be established: a) The structure or tree whose demolition or felling is sought must pose an imminent threat, due to the danger of falling, to the rights of the possessor or passersby (their physical integrity, life, or property), or it must be capable of damaging public property. b) Any person with an interest has standing to bring the action (legitimación activa) when the effects of the fall may affect public property.

Otherwise, standing belongs to the person affected by those effects. c) As to standing to be sued (legitimación pasiva), if the tree or structure in question is under the control of or on land owned by a specific person, that person must be sued because it is property under that person’s responsibility. However, if the tree is in a public-domain area (zona demanial) ([Dirección3] , [Dirección4] of [Dirección5] coastal zone) or a publicly accessible area, or in public-domain protection areas (strips along rivers, lakes, springs (nacientes) that supply aqueducts, etc.), there is in fact no one who may be sued directly because no particular person is responsible for the origin or cause of the alleged danger. d) Law. Although the legal system grants the right to demolish unsafe or dangerous structures and to fell unsafe or dangerous trees, there must be just cause for doing so. If a tree is involved, given the environmental protection regulations currently in force in the country, it must be verified that its felling (corta) or delimbing (desrame) is truly necessary, and the required prerequisites must therefore be met so as to prevent unlawful felling.

In this regard, even if a tree is diseased or at risk of falling, if it does not actually endanger persons’ physical integrity or property, its felling must not be authorized, since there is no other legally protected interest at stake and, on the contrary, allowing it to fall from natural causes may be necessary for the environmental balance of ecosystems. e) Current interest: the property for which permission to demolish or fell is requested must exist, and the situation involving an imminent danger of falling must remain present both when the claim is filed and when judgment is rendered. On the other hand, regarding the manner in which the evidence was assessed in the judgment under appeal, it must be emphasized that section 54 of the Law on Agrarian Jurisdiction governs the system of free assessment of evidence (libre valoración probatoria). This means that the adjudicator must examine and select the sources of evidence obtained in order to determine their probative force and resolve the dispute submitted for adjudication through perception, representation or reconstruction, and deductive or inductive reasoning.

It also means that the adjudicator must state the principles of equity or law on which the decision is based. “The system of free assessment of evidence supersedes the traditional system of legally prescribed evidence, as well as that of reasoned judicial assessment, which govern civil proceedings. The manner in which agrarian proceedings were conceived allows judges to assess broadly the facts alleged by the parties. This system is not arbitrary; on the contrary, under the free assessment of evidence, the assessment itself must be reasoned and critical and must be based on logic, experience, and psychology. In the reasoning of the ruling, the judge must set forth the grounds for the conviction that leads to the decision rendered. Unlike the system of legally prescribed weight, under which evidence is assessed subject to pre-established legal rules, and even the admissibility of evidence must have been established in advance by the legal system, under the system of free assessment the judge is free to admit evidence according to the judge’s own criteria” (decisions 398 of 06.06.2001 of the First Chamber and 3657 of 07.05.2003 of the Constitutional Chamber. To the same effect, precedents 206 of 26.03.1999, 46 of 26.04.1995; 66 of 06.02.,2009 and 364 of 28.05.2009 of this Court).

VII.The arguments on appeal are without merit. The appellant essentially alleges that the enforcement judgment under appeal is incorrect because the SINAC report was improperly assessed; according to the appellant, that report establishes that the trees are healthy (living) and that the problem affecting the gutters arises from their proximity to the spring. The appellant further contends that the order to fell the trees would cause environmental damage because it would reduce water infiltration, which would not support the aquifer-recharge process and would therefore cause the spring to dry up. It must be clarified that the judgment under appeal ordered only the two eucalyptus trees to be felled. As to the other three trees (poró and balsa), only pruning was authorized. Contrary to the appellant’s assertion, the cited evidence—official letter SINAC-ACC-OT-1563-2020 of November 23, 2020, from the Turrialba-Jiménez Office, MINAE—clearly determines that the eucalyptus trees pose an imminent danger of falling, both because of their condition and their lean.

It therefore directly recommends that they be felled. As to the other trees, it recommends pruning. In its final observations, whose content was not rebutted by the appellant, the report expressly states: “…e. The trees are currently in fair condition; their height will increase over time; some currently exhibit disease and trunk damage, and a large portion of their crowns lean toward residences. f. Pruning would not be appropriate for trees 1 and 2 because they are very tall and would prolong the danger; as to trees 3, 4, and 5, substantial crown pruning is appropriate. Pruning would eliminate the danger temporarily because these trees will grow again. g. These species are not species with reduced populations or at risk of extinction in the area…”. And Table 1, which describes the characteristics and location of each tree, specifies the following insofar as relevant: a) Eucalyptus: Living tree, in fair condition, with disease (termites) at the base, leaning toward residences. b) Eucalyptus: Living tree, in fair condition, with mechanical damage to its trunk, leaning toward residences.

  • C)Giant poró: Living tree, in fair condition, with exposed roots, leaning toward residences; d) Balsa: Living tree, in fair condition, leaning toward residences. e) Balsa: Living tree, in fair condition, leaning toward residences. Accordingly, the conclusion reached by the adjudicator is correct in light of the purpose of the proceeding, because the prerequisites for ordering the felling of those two eucalyptus trees and the pruning of the remaining trees have been met, in order to protect the property and lives of the persons residing in the nearby homes, who could be harmed if the eucalyptus trees were to fall. As indicated in the report, those trees not only have a dangerous angle of fall toward those structures; they also have physical problems affecting their stability, because one is infested with termites and the other has mechanical damage to its trunk.

VIII.With respect to the claim that the location of the structures is what causes the damage to the gutters and the other problems alleged, it was indeed established that they were located very close to the spring, and the protection areas may therefore be being encroached upon. However, until the legality of that situation is legally determined in the appropriate forum, which falls outside the scope of this type of proceeding, the relief requested in this proceeding must still be adjudicated. Accordingly, the judgment under appeal also ordered “…that this matter be brought to the attention of the Public Prosecution Service so that it may investigate the possible commission of an offense involving encroachment upon a water-resource protection area (área de protección hídrica).” In light of the foregoing, although the felling of trees located around a spring—particularly those that supply aqueducts or may do so in the future—is an activity that must be avoided and that constitutes an offense under certain conditions, there are circumstances in which it is appropriate to order such felling, for example, when necessary to protect human life and physical integrity from definite and imminent dangers.

The summary demolition or felling proceeding exists specifically to assess such situations, without this implying that the fundamental right to a healthy and ecologically balanced environment, recognized in Article 50 of the Constitution, is being disregarded or violated. Cases such as this one involve the concurrence of fundamental rights: life and physical integrity on the one hand, and the right to a healthy environment on the other. Such situations must be resolved using criteria of reasonableness and proportionality that allow for sustainable development. In this regard, although they analyze other types of fundamental rights, in judgments 1619 of 24.012020 and 17098 of 01.07.2021, the Constitutional Chamber explained the following concerning conflicts between fundamental rights: “… in all these matters, one must bear in mind a fundamental premise and a historical constant: there are no absolute fundamental rights, except the right not to be subjected to cruel, inhuman, or degrading treatment… in cases in which one fundamental right conflicts with another, recourse must be had to the principle of practical concordance and, consequently, a balancing assessment must be made between the rights in conflict…”.

In this case, it was established that there are in fact structures used as residences that could be affected by the eucalyptus trees falling, and the prerequisites of dangerousness and necessity were therefore duly proven. The SINAC technical report provided a balanced basis and assessment of the impact of the conclusions it contains and therefore recommended felling only two of the five trees identified in the request. The other three currently need only be pruned, regardless of whether their condition may change in the future. In its seventh and eighth recitals, the judgment under appeal analyzes the prerequisites for this type of proceeding and, based on the cited report, likewise concludes that only the two trees posing an imminent danger of falling that could endanger the lives of the persons residing in the nearby houses must be removed by felling. As to the environmental harm, the removal of vegetation or trees undeniably has an impact on ecosystems, usually a negative one.

However, apart from what has been explained concerning conflicts between fundamental rights, the appellant did not establish, as asserted, that the ordered felling of the two eucalyptus trees or the pruning of the other three would have such an impact on water infiltration that it would prevent aquifer recharge of the spring and cause it to dry up. None of this was established (section 41.1 of the Code of Civil Procedure, applied supplementarily in agrarian matters).

IX. In accordance with the foregoing, the judgment under appeal must be affirmed as to the matters appealed

The judgment is affirmed as to the matters appealed.

VOTO N° 0015-F-2022 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las diez horas cuarenta y ocho minutos del siete de enero de dos mil veintidós.- SUMARIO DE DERRIBO interpuesto por [Nombre1] , mayor, casada, cédula CED1 , vecina de Turrialba, Pavones; contra [Nombre2] , mayor, casada, ingeniera agrónoma, vecina de Turrialba, Pavones, cédula CED2 . Se tuvo como parte interesada al Estado, representado por la Procuraduría General de la República, representado por Heilyn Sáenz Calderón, abogada, vecina de San José, cédula CED3 . Actúa como defensor público de la actora: [Nombre3] ; de la demandada: [Nombre4] . Tramitado ante el Juzgado Agrario del Turrialba.

Redacta la Juez Alpízar Rodríguez, y;

CONSIDERANDO:

I. SOBRE LA DEMANDA

La parte actora pide se declare en sentencia: "Principales: 1) …se ordene a la demandada proceder con la corta de los árboles en cuestión (cinco) en un plazo prudencial el cual será fijado por su autoridad. 2) Que en caso de que la demandada no proceda con la corta de los árboles dentro del plazo establecido, se autorice inmediatamente a la actora a realizar dichos trabajos, los cuales serán cobrados posteriormente en Ejecución de Sentencia. 3) En caso de oposición, se condene a la demandada a pagar ambas costas. Subsidiarias: 1) …se ordene a la demandada proceder con la poda de los árboles en cuestión en un plazo prudencial el cual será fijado por su autoridad. 2) Que en caso de que la demandada no proceda con la poda del árbol dentro del plazo establecido, se autorice inmediatamente a la actora a realizar dichos trabajos, los cuales serán cobrados posteriormente en Ejecución de Sentencia. 3) En caso de oposición, se condene a la demandada a pagar ambas costas" (apartado de escritos: archivo 21/10/2020 03:40:28).

II. SOBRE LA CONTESTACION

La parte demandada contestó negativamente sin interponer excepciones, pero alega que la corta de los árboles, por estar en una naciente, provocaría daño ambiental. Además, las casas próximas tienen poco tienen menos de 15 años de construidas y están a escasos 10 metros de la naciente. Las hojas caen en las canoas porque irrespetan el área de protección, pero ese daño no es motivo para cortar los árboles. Por no representar peligro para la vida humana y por la ubicación de las construcciones, pide se rechace la demanda (apartado de escritos: archivo 13/11/2020 02:47:51). La Procuraduría General de la República (PGR) no se opuso (apartado de escritos: archivo 16/11/2020 a las 01:38:08).

III. RESOLUCION APELADA

El juez Yeison Rodríguez Fernández, del Juzgado Agrario de Turrialba, en sentencia 70 de 3 de agosto de 2021 resolvió: “En razón de lo expuesto y la normativa citada, se ACOGE la presente demanda sumaria de derribo interpuesta por [Nombre1] contra [Nombre2] , en la forma que se dirá: Se ordena a la demandada [Nombre2] proceder a la corta total de los dos árboles de Eucalipto que son objeto del presente proceso y que fueron debidamente marcados con los números uno y dos con pintura azul, así como proceder a una poda profunda del árbol de Poro y de los dos árboles de Balsa que son objeto de este proceso y que fueron debidamente marcados con los números tres, cuatro y cinco con pintura azul, mismos que se encuentran plantados en su propiedad inscrita en la provincia de Cartago, matricula número CED4 - [Dirección1] , la cual se ubica en Pavones de Turrialba. Las labores de corta y poda deberán ser realizadas por la demandada en el plazo CINCO DÍAS a partir de la firmeza de la presente sentencia, en caso de no realizar dichas labores en el plazo establecido, queda autorizada la actora [Nombre1] a realizar dichos trabajos.

Los gastos de derribo corren a cargo de la demandada, quien debe además tomar todas las medidas de seguridad y técnicas para evitar daños a terceros, así como evitar daños innecesarios al ambiente y los recursos naturales del medio circundante, que deben verse afectados sólo en lo estrictamente necesario, así como cumplir con las demás recomendaciones dadas en el informe del MINAE. Si es del caso, debe dar aviso a terceras personas que puedan verse afectadas con la caída de alguna rama. Deberá la demandada reponer los árboles que se autoriza cortar con especies nativas de pequeño crecimiento, los cuales deberán ser sembrados en los sectores de interés y que sean de utilidad para garantizar la conservación del suelo y el área de protección hídrica. Para el aprovechamiento de los productos resultantes de los árboles a cortar y podar, si es de su interés, deberá la parte interesada realizar los trámites correspondientes ante el órgano administrativo a fin de gestionar los permisos para la extracción, aserrío y traslado de los mismos, y asumir los costos respectivos que generen esas labores.

Se resuelve sin especial condenatoria en costas. Se ordena hacer de conocimiento el presente asunto al Ministerio Público a fin de que investigue la posible comisión de un delito por invasión a área de protección hídrica.- Una vez firme esta sentencia, remítase copia de la misma para efectos de las autorizaciones concedidas y para lo de su cargo a la Oficina Regional del MINAE en Turrialba, a quien se le ordena controlar y vigilar el cumplimiento de lo dispuesto en esta sentencia, autorización que se circunscribe al control para que no se corten y poden más árboles que los cinco permitidos en la presente resolución, y además la entrega de guías y placas para el transporte de dichos árboles cuya corta se autorizó o sus productos forestales en caso de ser requerido. Notifíquese" (apartado de documentos asociados: archivo 03/08/2021 14:10:28).

IV. SOBRE LOS HECHOS PROBADOS Y NO PROBADOS

El Tribunal comparte los hechos probados por encontrar sustento en la prueba, salvo el tercero, que corresponde a una actuación procesal. Se adiciona al cuarto: El informe técnico del SINAC especifica además que la poda, no aplicaría, en el árbol 1 y 2, ya que estos se encuentran a mucha altura y prolongaría el peligro, en cuanto al árbol 3, 4, 5, si aplica una poda profunda por lo alto. Con la poda se eliminaría el peligro momentáneamente, ya que estos árboles nuevamente crecerán. Se agregan los siguientes hechos: Sexto: La naciente dentro de cuya área de protección se encuentran los árboles objeto del proceso, tiene el caudal suficiente para reforzar los acueductos cercanos, por lo que el terreno donde se encuentra presenta una alta fragilidad hídrica, además de ubicarse en la sección superior de la subcuenca del Río Jabillos de la cuenca de Río Reventazón-Parismina (ver informe del Instituto Costarricense de Acueductos y Alcantarillados, oficio UEN-GA-2021-01454 de 14 de junio de 2021, emitido por el Área Funcional de Cuencas Hidrográficas).

V. RECURSO DE APELACION

La parte demandada apela con base en lo siguiente, que se resume para su análisis: Existe indebida valoración de la prueba. Alega, del informe del Sistema nacional de Áreas de Conservación, Área de Conservación Central, documento SINAC-ACC-OT-1563-2020, realizado por el Ing. Freddy Pizarro Arias, Encargado Desarrollo Forestal de la Oficina de Turrialba-Jiménez-MINAE se puede determinar que todos los árboles se encuentran dentro del área de protección de la naciente, cuerpo de agua con [Dirección2] . Además, todos se encuentran vivos, en regular estado y se han regenerado libremente, dentro de área de protección hídrica. En tercer lugar, las cuatro casas de habitación se ubican dentro del radio de protección de la naciente, con distancias que van de 8,04 metros a 49,72 metros, irrespetando e invadiendo el área de protección regulada en la Ley 7575. Otorgar la eventual corta o poda de los árboles puede de hecho causar una merma en la oportunidad de infiltración de las aguas de lluvia durante el invierno, dado que la ausencia o disminución de cobertura boscosa no favorece el proceso de recarga acuífera, por el contrario, favorece la aparición de un mayor escurrimiento superficial y con él los procesos erosivos; o en su peor caso, secar la naciente.

Sobre el derecho a un ambiente sano y ecológicamente equilibrado. El artículo 50 de la Constitución Política reconoce que "toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado". El objetivo primordial del uso y protección del ambiente es obtener un desarrollo y evolución favorable al ser humano. La calidad ambiental es un parámetro fundamental de la calidad de vida; al igual que la salud, alimentación, trabajo, vivienda, educación, entre otros. Pero si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene el deber de protegerlo y preservarlo para uso de las generaciones futuras; pues de conformidad con el principio de "lesión", el legítimo ejercicio de un derecho tiene dos límites esenciales; por un lado, los iguales derechos de los demás, y por el otro, el ejercicio racional y el disfrute útil del derecho mismo. De igual manera, el Estado tiene la obligación de procurar la conservación, protección y adecuada administración de los recursos naturales y el medio ambiente en general.

Objeta que el Juzgado resolviera de la forma en que lo hace, lo que afirma le causa un gran perjuicio y al medio ambiente, ya que la corta de árboles disminuiría la infiltración de aguas, lo que no favorece el proceso de recarga acuífera y por ende provocaría que la naciente se llegue a secar. Solicita se declare con lugar el recurso de apelación (apartado de escritos: archivo 11/08/2021 10:23:01).

VI.Por lo que es objeto de apelación, es importante tenerse presente que el proceso de derribo tiene por fin determinar si un árbol o construcción, por su mal estado, constituye un peligro inminente de caída que afecte la vida y seguridad de las personas, su patrimonio o bienes de naturaleza pública (numerales 310 del Código Civil y 108 Código Procesal Civil, aplicado supletoriamente). La naturaleza sumaria de dicho proceso buscar determinar si esa obra o árbol deben ser asegurados (v.g. mediante anclajes, soportes, etc.), modificados (como sucede cuando se autoriza la poda de un árbol) o eliminados (derribo, por ejemplo), para prevenir una situación dañina que, de no tomarse esas medidas, tiene un alto grado de probabilidad (inminencia) de acontecer en tiempo presente o muy cercano. Como presupuestos de este tipo de proceso, se requiere entonces que se compruebe: a) La obra o árbol cuyo derribo se pretende constituya una amenaza inminente, por peligro de caída, para los derechos de la persona poseedora o para las transeúntes (integridad, vida o su patrimonio), o bien pueda perjudicar alguna cosa pública. b) La legitimación activa recae sobre cualquiera que tenga interés cuando el efecto de la caída puede afectar un bien público.

De no ser así, la legitimación corresponde a la persona afectada con dicho efecto. c) En cuanto a la legitimación pasiva, si el árbol u obra cuestionada está a cargo o en terrenos propiedad de una persona determinada, será está la que deba ser demandada, ya que es un bien bajo su responsabilidad. Pero si el árbol está en una zona demanial ([Dirección3] , [Dirección4] de [Dirección5] marítimo terrestre) o de acceso público, o bien en áreas de protección demaniales (franjas a orillas de ríos, lagos, nacientes que abastecen acueductos, etc.), no existe en realidad alguien que demandar directamente, al no ser responsabilidad de una persona determinada el origen o causa del peligro alegado. d) Derecho. Si bien el ordenamiento jurídico concede el derecho de derribar obras y árboles ruinosas o peligrosas, debe existir una causa justa para ello. Si se trata de un árbol, dada la normativa de protección ambiental vigente en el país, se requiere verificar que su corta o desrame sea realmente necesaria, por lo que se deben cumplir los presupuestos exigidos, para así evitar un derribo ilegal.

En ese sentido, aunque un árbol esté enfermo o con peligro de caída, si ese acto no afecta en realidad la integridad de las personas o su patrimonio, no debe autorizarse su derribo, pues no existe otro bien jurídico que tutelar y, por el contrario, puede ser necesario para el equilibrio ambiental de los ecosistemas, dejar que se caiga por causas naturales. e) Interés actual: el bien que se pide se permita sea derribado, debe existir y mantenerse la situación de peligro inminente de caída, tanto cuando se plantea la demanda como cuando se emite la sentencia. Por otro lado, en cuanto a la forma como se apreció la prueba en la sentencia recurrida, es necesario resaltar que el numeral 54 Ley de la Jurisdicción Agraria regula el sistema de la libre valoración probatoria. Ello implica que la persona juzgadora debe estudiar y seleccionar las fuentes de prueba obtenidas, para establecer su eficacia y resolver el conflicto sometido a su conocimiento, a través de la percepción, la representación o reconstrucción y el razonamiento deductivo o inductivo.

También significa que debe expresar los principios de equidad o de derecho sobre los cuales basa su criterio. "El sistema de la libre valoración de la prueba supera el clásico sistema de la prueba legal así como el de la sana crítica, que rigen en el proceso civil. La forma como ha sido concebido el proceso agrario le permite al juez valorar ampliamente los hechos alegados por las partes. Dicho sistema no es arbitrario, por el contrario en la libre valoración de la prueba la misma deber ser razonada, crítica, basarse en la lógica, la experiencia y la sicología. En la motivación del fallo el juez debe exponer los motivos de convicción que lo llevan a resolver en los términos que lo hace. A diferencia del sistema de tarifa legal, en el cual las pruebas se aprecian con sujeción a reglas legales previas, e incluso la admisibilidad de pruebas debe estar previamente señalado por el Ordenamiento Jurídico, en el sistema de libre apreciación el juez tiene libertad para admitir pruebas conforme a su criterio” (votos 398 de 06.06.2001 de la Sala Primera y 3657 de 07.05.2003 de la Sala Constitucional. En igual sentido precedentes 206 de 26.03.1999, 46 del 26.04.1995; 66 del 06.02.,2009 y 364 de 28.05.2009 de este Tribunal).

VII.Lo apelado no es de recibo. Básicamente alega la parte apelante que la sentencia de ejecución recurrida es incorrecta, porque se valoró incorrectamente el informe del SINAC, según el cual, afirma, se prueba que los árboles están sanos (activos) y que el problema de las canoas se genera por su ubicación próxima a la naciente. Considera además que la orden de corta de loa árboles causaría daño ambiental porque disminuiría la infiltración de aguas, lo que no favorece el proceso de recarga acuífera y por ende provocaría que la naciente se llegue a secar. Debe aclararse que en la sentencia recurrida solo se ordenó la corta respecto de los dos árboles de eucalipto. Para los otros tres (de poró y de balsa) solo se autorizó la poda. La prueba citada -oficio SINAC-ACC-OT-1563-2020 del 23 de noviembre de 2020 de la Oficina de Turrialba-Jiménez. MINAE-, contrario a lo que afirma la parte apelante, determina claramente que existe peligro inminente de caída de los árboles de eucalipto, tanto por su estado como por su inclinación.

Por eso recomienda directamente su corta. Respecto de los otros árboles, recomienda la poda. Dice expresamente el informe, en sus observaciones finales, cuyo contenido no fue desvirtuado por quien apela: “…e. Actualmente, los árboles se encuentran en regular estado, su altura va aumentar con el paso del tiempo, actualmente algunos presentan enfermedades, daños en su tronco y gran parte de sus copas se encuentran inclinadas hacia casas de habitación. f. La poda, no aplicaría, en el árbol 1 y 2, ya que estos se encuentran a mucha altura y prolongaría el peligro, en cuanto al árbol 3, 4, 5, si aplica una poda profunda por lo alto. Con la poda se eliminaría el peligro momentáneamente, ya que estos árboles nuevamente crecerán. g. Estas especies, no representan especies que se encuentren en poblaciones reducidas o en peligro de extinción en la zona…”. Y en el cuadro 1, en el que se describen las características y ubicación de cada árbol, se especifica en lo que interesa lo siguiente: a) Eucalipto: Árbol vivo, en regular estado, con enfermedad (comején) en la base, inclinado a casas de habitación. b) Eucalipto: Árbol vivo, en regular estado, con daños mecánicos en su fuste, inclinado a casas de habitación.

  • C)Poro gigante: Árbol vivo, en regular estado, con raíces expuestas, inclinado a casas de habitación; d) Balsa: Árbol vivo, en regular estado, inclinado a casas de habitación. e) Balsa: Árbol vivo, en regular estado, inclinado a casas de habitación. Por ello, la conclusión a la que llegó la persona juzgadora, de acuerdo con el fin del proceso, es correcta, dado que se cumplen los presupuestos exigidos para ordenar la corta de esos dos árboles de eucalipto y la poda de los restantes, con el fin de resguardar la seguridad patrimonial y la vida de las personas que habitan en las casas cercanas, que se podrían ver afectadas en caso de caer los de eucalipto. Estos, como se indicó en el informe, no solamente tienen un ángulo de caída peligroso hacia tales construcciones; también tienen problemas físicos que afectan su estabilidad, por estar uno enfermo con comején y tener el otro daño mecánico en su fuste.

VIII.Con respecto al reclamo de que la ubicación de las construcciones es lo que genera el daño en las canoas y los problemas reclamados, ciertamente quedó demostrado que se encontraban muy próximas a la naciente, con lo cual puede que se estén irrespetando las áreas de protección. Pero mientras la legalidad de esa situación no se determine legalmente en la vía pertinente, lo cual escapa a este tipo de procesos, no puede dejar de resolverse lo solicitado en este tipo de proceso. Por ello se dispuso también en la sentencia recurrida “…hacer de conocimiento el presente asunto al Ministerio Público a fin de que investigue la posible comisión de un delito por invasión a área de protección hídrica”. En función de lo explicado, aunque la corta de árboles ubicados alrededor de una naciente, máxime aquellas que abastecen acueductos o sirvan para ello en el futuro, es una actividad que se debe evitar y que en ciertas condiciones es un delito, en algunos supuestos procede ordenar se realice, como, por ejemplo, si está de por medio la protección de la integridad y vida humana ante peligros ciertos e inminentes.

Para valorar esas situaciones existe precisamente el proceso sumario de derribo, sin que ello signifique dejar de lado ni irrespetar el derecho fundamental a un ambiente sano y ecológicamente equilibrado, reconocido en el artículo 50 constitucional. Se está en casos como el presente ante la concurrencia de derechos fundamentales, como lo son la vida e integridad por un lado y el derecho a un ambiente sano por el otro. Este tipo de situaciones debe resolverse con criterios de razonabilidad y proporcionalidad, que permitan un desarrollo sostenible. Al respecto, aunque se analizan otros tipos de derechos fundamentales, en las sentencias 1619 de 24.012020 y 17098 de 01.07.2021 la Sala Constitucional explicó sobre la colisión de derechos fundamentales lo siguiente: “… en todas estas cuestiones hay que tener presente una premisa fundamental, y una constante histórica, en el sentido de que no hay derechos fundamentales absolutos, excepto el derecho a no ser sometido a tratos crueles, inhumanos o degradantes… en aquellos casos, en los que entra en colisión con otro derecho fundamental se debe recurrir al principio de la concordancia práctica y, por consiguiente, es menester hacer un juicio de ponderación entre los derechos que están en conflicto…”.

En este caso se demostró que efectivamente existen construcciones usadas como casas de habitación, que pueden verse afectada antes la caída de los árboles de eucalipto, por lo que los presupuestos de peligrosidad y necesidad fueron debidamente probados. En el informe técnico del SINAC, de manera equilibrada, se fundamentó y valoró el impacto de las conclusiones que contiene, por lo que sólo se recomendó la corta del dos de los cinco árboles que se solicitaba. Los otros tres actualmente sólo deben ser podados, independientemente de que en el futuro pueda cambiar su situación. La sentencia recurrida, en sus considerandos séptimo y octavo, analiza los presupuestos requeridos para este tipo de procesos y con base en el informe citado, concluye de igual forma, que deben ser eliminados mediante corta solamente los dos árboles que implican un peligro inminente de caída que pueda afectar la vida humana de las personas que habitan las casas próximas.

En cuanto al daño al ambiente, innegablemente la eliminación de vegetación o de árboles causa un impacto en los ecosistemas, usualmente negativo. Pero aparte de lo explicado sobre la colisión de derechos fundamentales, la parte apelante no demostró, como lo afirma, que la corta ordenada de los dos árboles de eucalipto ni la poda de los otros tres conllevaría un impacto tal para la infiltración de las aguas que impediría la recarga acuífera de la naciente y provocaría se seque. Nada de ello fue demostrado (numeral 41.1 del Código Procesal Civil, aplicado supletoriamente en materia agraria).

IX. De conformidad con lo expuesto, en lo apelado, procede confirmar la sentencia recurrida

POR TANTO

En lo apelado, se confirma la sentencia.
